I bought premium Simmon's mattress and after eight months, it offers no back support and sags. The customer service sent a technician, who measured the sag, but did not measure the lack of support and failure of springs. In my opinion, Simmon's warranty is nothing short of fraud.

It is fascinating to note that Simmon's feels that the mattress should contour to the shape of my body. Silly me, I thought a mattress is supposed to support my body. Secondly, they did not measure the resistance of the springs, so it is impossible to have concluded that there is no structural failure. Finally, if compaction is to be expected, perhaps that should be disclosed up front prior to purchase. This is in my opinion nothing short of consumer fraud.

My back is in pain and I am sleeping in the guest room. I will have to spend another couple thousand dollars on a replacement mattress made by a legitimate company with integrity. Never again will I buy Simmon's.

I purchased a Simmons Beautyrest Mattress in 11/2010. It's falling apart. The end is sagged 1 inch. I called the company. They said the warranty was void due to a stain, which there is none. In searching, I found the National Bedding Co had a lawsuit against them in 2009, with the same problem and same "stain" excuse. They're at it again! My back is killing me, and I have no sleep. Can I give a negative score? Please help! NYS Division of Consumer Protection sent a letter on my behalf. There was no response. BBC and CPA all said to sue in small claims.

I purchased a Simmons NXG queen-sized mattress and box spring for $3,000 in 07/08. Luckily for us, the salesman also threw in a breathable (but stain-proof) mattress cover that fits over the entire mattress and seals it much in the way a Ziplock bag would.

I made the delivery guys wait while I put this over the mattress and zipped it shut.

Three years later, the mattress has a huge bulge on the side that we non-affectionately call "the tumor". The mattress does not need to be flipped and it was not. Simmons sent out an independent inspector since we had moved out of the state where we purchased this from.

The inspector was very nice. He told us that he is not affiliated with Simmons and that he can make no rulings and is only there to document. He found that the bulge measures over 2" and runs about 1/4 way over the length of the mattress.

Simmons sent a letter agreeing to a replacement, which is wonderful. First of all, the letter was either backdated or held as I was given three days to get the tags, signed letter and cc info faxed to them. That is not much time at all, especially since I do not have a home fax.

They said that I am in charge of disposing of the old mattress. (Why do they deny claims due to stains if they never handle the old mattress??? This is wrong!!)

The phone representative also stated that I needed to have the "Do not remove except by the consumer" tag on the mattress. I have mine in there, but if the consumer is allowed to remove it, how can Simmons require it to be left on when the tag, the salesman and the sales paperwork make no mention of this fact? How would a person possibly know they needed to keep that tag!

I also have to pay $85 to have a new mattress sent to me. I really do not understand why I should have to pay this if it is their defective product. If they would quit using cheaper materials, they would not be inundated with warranty claims. Seems to me that the cost of a warranty claim is the incentive for a company to make a quality product.

While I am quite thankful that I'm apparently one of the "lucky few" who will receive a replacement, I am deeply disturbed by a warranty with so many loopholes.

In September 2008, I bought a Simmons mattress from 1800 mattresses. Approximately three months later, the mattress started to sag significantly on top and also sag along the side (wall) on my husband's side.

We complained to 1800 mattresses who sent us to Simmons direct. They viewed the form we completed and photos and sent us a response saying the mattress had not sagged more than three inches so this was normal. I asked them to come personally to view the mattress and particularly the side (wall), which was concaved. They did not and said they were within their rights to refuse.

Now the mattress is unusable and had dipped on my side also and I am only 97 pounds and very petite. I now need to replace the mattress and do not believe I should incur the costs to do so. I have seen a significant number of consumers also with similar complaints so something needs to be done about this as this mattress was approximately $2 ,200 and is expensive to replace. The dip is so bad now, my husband has to sleep on my side for fear of falling off the bed!

    This is disgraceful!

Within 30 days, the center of the mattress was sinking . I put a straight edge across and it was more than 3 inch drop in the center. I called the store they said they would send someone out to check it . After numerous phone calls, I finally stopped by and complained to the owner Mr. **, he told me I needed to place planks across the bed . I informed him that it was a full mattress.

The store finally ordered us a new mattress. It was delivered on 7-24-09. Since then, this new mattress is doing the same thing, we have tried to find out if there is something wrong with that brand and have contacted Wolf's again, but no one has called us back. I finally stopped by 5-21-11 to complain again but no one has called us back and you have to talk to Mr. **.

You can't sleep in the bed together with out rolling together. Now, even if only one of us is in bed you roll to the center of the bed. our backs hurt and we do not sleep very well . We paid $736.05 and this mattress has a 10 year warranty.

I purchased a Simmons Beautyrest NxG in February 2010 with an original priced at $5000 and on sale for $3000. It was delivered dirty with cracked box spring and within one year, the mattress bulged out a tumor 12" long by 8" wide. The inspector said that this was normal wear and he did not see anything abnormal. This mattress does not even feel as comfortable as it felt in the store. I have my fourth call into the store and another inspector is coming out. The photo clearly show all I have stated. It is bigger than a football sticking out.

I want a new bed, as comfortable as the store sample. I am extremely stressed and unable to reach over bed or tuck it in the mattress pad they sold us. The back of my legs hurts when getting out of bed.

I purchased a Simmons beauty rest (monarch) mattress from Rockaway Bedding 4 years ago. They are currently out of business. There is a dip in the mattress, making it very difficult to sleep on. I called the company and they sent mattress marshals to my house to take pictures of the bed to see if I am eligible for a new one. They later told me that my claim was denied because I purchased a floor model and there are no warranties on floor models. I had sent them the original receipt thinking that would be a help to them. When I received the mattress it was all wrapped in plastic. I just do not understand why Simmons does not stand by their product regardless if you have a warranty or not. I spent a thousand dollars on this mattress and my husband and I cannot even sleep comfortably on it.

I bought a Beautyrest "Automatic Blanket" on November 13, 2010. This is an electric blanket. The blanket seems to function okay, but the preheat function doesn't work. According to the instruction booklet, the preheat setting is designed to quickly warm up the blanket, then automatically return to the most recent setting, all within ten minutes.

When I press the preheat button, absolutely nothing happened. I returned the blanket on November 30 for another just like it, in every way, it turns out. I had the same problem, nothing happens when pressing the preheat button. Attempts to contact someone at Simmons' customer care office in Fremont, CA were almost impossible. The number, typically cannot physically connect. I get a fast busy signal, which is usually an indication of mechanical phone difficulty. After finally getting through to someone, my call was transferred to someone (at Simmons' office in Fremont, CA), who said that no one else had reported this problem.

She said, however, that she would personally test the "controls" (the physical device that operates the electric blanket), and send me an email of her progress, and to mail me controls that actually work. To date, I have received no email and no replacement controls for my blanket. My attempts to contact customer service were once again met by telephone line problems on their end. This is not exactly what I'd counted on, and has caused me to never again purchase a Simmons' product.

After 38 months of easy use, (my wife and I combined weigh 300 pounds) the sides of the mattress collapsed and we attempted to get Simmons to reimburse us for this faulty product.

Unfortunately, we misplaced the proof of purchase that both the retailer and Simmons require. Even though we did register on line, they both refused to make good on the "guarantee! I stumbled across this website when was googling what mattress I can purchase that won't sag in the middle! I too have a Simmons (Slumberpedic) mattress that began to sag about a year after I purchased it. I had to pay a $30 fee for a technician from the place I purchased it to come and look at it and was told twice that the indent was normal. It wasn't deep enough for the warranty to take affect and give me a new one.

Hello, mattresses are made for sleeping on, you'd think they could make them so they don't sink in the middle! Not only is it uncomfortable for sleeping but looks bad as well! And when you pay that much for a mattress, you wouldn't think you'd have this issue. I'm going to be looking for a new mattress, (not that I really want to spend another $800 or so), and I will not be purchasing a Simmons now that I know I'm not the only one who has had this issue.

We purchased a Simmons Beautyrest Exceptionale Ashton, Visco Plush mattress from Macy's Home Store in Edina, MN. After less than a year, the mattress began to sag on both sides of the bed, creating very uncomfortable sleeping conditions. We contacted customer service and they sent a technician to measure the depth of the depressions. Immediately upon seeing the mattress, the technician said, "You'll be getting a new mattress."

He completed his measurements and confirmed that there was structural failure and that the depressions were in the range necessary to replace the mattress. Shortly after he left, I received a call from customer service telling me that the warranty was void due to a faint stain on the mattress at the foot of the bed. The technician never mentioned it and the customer service rep did not budge on her decision. I contacted the mattress manager at Macy's who told me he would contact Simmons and dispute the decision.

After one week, he called back and informed me that he couldn't get Simmons to reverse their decision. We are sleeping on a mattress that actually causes us discomfort, that by their own admission failed structurally within the warranty period but that they won't replace because of a cosmetic blemish. This is the worst example of customer service from a manufacturer and retailer that I have ever experienced.

We bought a Simmons Duel Marlowe mattress only 3 months ago for about $2,000. We discovered severe signs of wear where we sleep. After contacting Mattress Warehouse Dudley Farm, WV, where we purchased it, they sent an inspector to look at it. Our claim was denied because of a stain where we laid, even though the complaint was about the mattress breaking down.

I had first thought the stain was due to cheap sheets on the bed, but after reading several complaints on here, I am convinced these mattresses are designed to stain after people sleep on them thereby voiding the warranty. Simmons, in my opinion, knows they are selling an inferior product, and uses the staining to get out of their warranty. Before I owned a Sealy mattress for 15 years, only got rid of it because it was a full, and I wanted a queen, and it looked brand new when I gave it away.

We have a Simmons Beautyrest Black mattress. It cost around $2500 so it was supposed to be top of the line. Three strand triple twist no sag construction-- not. Both sides of the mattress have turned into a deep gully. I have repeatedly contacted Simmons by email and they ignored them. I weigh 135, my husband 220. We have rotated as instructed, no relief, no benefit. The product is defective, flawed design.

Our backs are in constant pain. We do not sleep through the night sometimes as many as 10 times a night awake. I have purchased an encased 2" foam topper. Under this, I have placed many layers of fabric items to fill the gully like spackling in a hole in the wall. The gullies are layered with bedspread, towels, coverlets all in an attempt to bring the bed back up to the proper height then the encased 2" foam topper ($300).

My husband and I purchased a Simmons mattress with a 10-year warranty. After about 5 years, the mattress began sagging and we asked to invoke our warranty. After several months, Simmons sent an independent contractor from Mattress Marshals to inspect the mattress. We did some online research on this company, whose sole purpose is to save the mattress company the cost of a claim. Online complaints included that unless the mattress indentation was more than 1 1/2 inches in depth, it was within normal warranty standards. Online reports also stated that warranties had also been denied due to "stains" on the mattress.

When the Mattress Marshal arrived, I gave them the benefit of the doubt, but watched him measure. In some measurements, the indentation was over 2 inches deep. In his photos and his reports, he wrote, however, that no indentation was more than an inch and a quarter, exactly as the website said they would claim. When we received our warranty denial, I called to express my concern and was told that there were now "stains" on the mattress photos that he submitted. I asked to see these stains and the photos and was denied. They claimed this is their property and they do not share the photos. Additionally in their denial letter, they stated: "Today's bedding products are much thicker than they were a few years ago and body impressions will appear with use due to the compaction of the upholstery layering. Please be assured that this is not an indication of an inferior product".

I am not sure if we were not supposed to "use" the product in order to maintain its structure or if they want us to buy a new mattress from them because "today's bedding products" are seemingly better than in years past. Their solution was to wait 90 days and send out another inspector or have me take my own photographs and send them in. They refused email contact, will not allow me to send pictures in via email, but I have to send them certified original prints to their corporate office. I am 38 years old, exercise daily and have never had back problems or pain in my life. Now I wake up every morning to terrible back pain, as does my husband. We joke that there is/are "Jen and Tim" size holes in the bed, in the shape of our bodies.

We purchased this mattress with a 10-year warranty. This product has been discontinued and Simmons will not tell us why. We would be happy with credit towards a new, different brand of mattress, as we have provided proof of purchase, accommodated their inspection, etc.

I bought the Simmons "Fontallina" mattress in February 2010. I never had any problems with Simmons. The springs were tied separately, so definitely no sag, etc. While changing the bed one day, I noticed sagging where my shoulders and hip usually lay. Now, this mattress, supposedly on sale for half price, was over $1000! I wish I had checked out this site before I bought it, but it was a spur of the moment buy, even though the mattress set I had was not that bad & I have had it for almost 10 years, for half the cost of the new one. Simmons sent a woman out to measure, etc. and she was really thorough and I thought maybe they would not do anything about it. About 2-3 weeks later I received a letter from Simmons saying they would replace it & to take the letter to the store, which I did. It is to be delivered in a couple days & now I am wondering if it will do the same thing!

Also, what really got me riled up was the fact that after charging $65 to deliver the original one, they are now charging another $65 to deliver & pick up the original. My contention is that I paid for delivery once; it is not my fault that the mattress was flawed, so why should I have to pay this fee, up front, before they would deliver the 2nd one? I cannot believe or maybe I can, the way things go today, that this is the same Simmons Company of old. The salesman said that was company policy led me to believe that was Simmons, not Mattress Warehouse. I know I will never deal with either company again & have mentioned that to family & friends! This mattress would be the last I would ever have to buy, and yes $65 twice does impact my finances!

I called Gardner White in Taylor, MI and they said they would send out a service person to inspect the mattress. They came and were here no more than 3 to 5 min. He looked, seen we had a stain on the mattress and said that we have to have someone else out to take out the stain and then if they got the stain out, and then we could have another person come out to do a measurement of the middle of the bed. I do not care about this stain, I am disappointed in this mattress and that's why I bought the warranty. This stain did not make the bed breakdown. I have been on the phone several times with Gardner White and I am sick of hearing their excuses about this stain. They are not discussing the construction of the mattress but are talking only about the stain.

My husband has had 2 back surgeries and is looking at another one, and most nights cannot sleep in this bed for an entire night. He ends up in our Lazyboy. Why are warranties even offered, when the company will not back them up? We as consumers pay a lot of money for these mattress sets and for a couple of years sleeping well sure doesn't add up. We have liked Simmons mattresses that we have slept on in hotel rooms in the past but having this set here at home, there is a lot of disappointment. We will never buy another Simmons product.

We previously had an ancient Simmons Beautyrest mattress and decided, as the advertisers tell us, we should buy new, upgrade, all the dust mites, old skin cells, etc., etc., etc. We purchased our new Simmons Black Helena model mattress in July of 08, and beyond the first few months, we have not had a pleasant night's sleep since. The pillow top material degrades permanently and then causes the bed to remain in a constant hammock-like state when we are sleeping in it. The triple stranding of the coils appear not to have a real effect on the firmness nor support.

I have garnered information from Mattress Firm that if the mattress does not have a certain depth depression without a body on it, well, we are out of luck. I weigh 133 lbs. and am 5' 7"; my husband is 220 lbs. and is 5' 10 ... hardly what one would think would stress the mattress to the point of discomfort we are both experiencing. We rotated it at the 6-month point, switched our respective sides ... Nothing works. When I get out of bed and see him still asleep, he looks like he has fallen into one of our famous Florida "sink holes." My back is sore every morning.

I purchased the Black Helena model specifically because of the triple twist coil feature and was assured the mattress wouldn't sag because of that. We loved our ancient Simmons Beautyrest. It still gave us a good night's sleep. At this point, after spending a considerable amount of money on what is presumably a premier mattress, I feel cheated, and stuck. I decided to check the Internet for other Simmons Black owners' ratings or a solution to bringing the mattress back to its original great feel it had in the store. There are several blogs and complaints of the same nature - the permanent compression of the pillow top, and "never having a good night's sleep" were both a consistent theme with this Simmons Black brand mattress. Initial quality and looks is 5 stars! After that, it doesn't rate a zero.

A king size mattress isn't a minor purchase and discarding it and buying some other brand is not within our budget. Do not buy any Simmons products. They are obviously not what they used to be.

It still is not 1.5 depressed so I continue to be screwed! This is very simple. I had Beautyrests when I was younger and they were fine. This time, in our new stately home 2 years ago exactly, on 8/28/07, we bought a $1,500 Cal King Novinger Lux Firm Mattress and it has been the nightmare of our lives! From the day we got it, it never felt like the one in the showroom, not nearly as firm! Then my wife always suffered from the materials. It made her too hot. This made her have to leave the bedroom and sleep elsewhere to get some shut eye, but after only a few months, the back pain began and I am feeling it strongly right now as there is no firmness to the mattress whatsoever!

As a reference, I'm not a small man but also not gigantic (6ft, 230lbs. My wife is 5ft at 130lbs). But let me say this and even knowing the mattress industry seems to be a non-caring, ruthless, lowdown industry, I am tired of not being taken seriously after buying a top of the line $1,500 product. So this time I will be ruthless posting something about your product and your company policies unless I get a favorable response! The last mattress I bought was $600 for a queen 11 years ago that now my daughter inherited. It's in far better shape than the one we bought from you, so as now someone said when buying another mattress, they don't make them like they used to! Well the pricing went up considerably so I want to get what I paid for!

If I have to go out and buy another mattress after 2 years and throw away $1,500, Simmons should be ashamed of themselves and I will raise hell as this has been a nightmare! There was one mattress firmer for another $200/300. Does that one last 2.5 years or 3? The warranty is crap, you've treated me the same way and Ortho, well, they adhere to your warranty so obviously it will get to be 1.5 depressed by that time get ready to pay doctor bills for two! I will wait for a response for one week and prepare and see all the places where I'll be blogging, posting, etc. about this injustice and lack of customer support from Simmons.

Simmons' response: If there are no other manufacturing defects in the bedding product, the normal tolerance level of impressions (1) must be exceeded in order to receive a replacement mattress.

Note: Not one word of, "We apologize." Nothing!

My husband and I bought a mattress from 1-800-mattress in Aug. 2004. That mattress was a Sealy Pillowtop and had deep impressions. In Dec. '07, we traded in the Sealy for a Simmons Beautyrest World Class Cypress Plush (commonly known as the Monrovia). This bed was heaven, for the first six months that is! We have deep body impressions and the side is bowing outward. My husband has had a lot of back pain and I thought it was just him. Then in April '09, I started to incur bad pain from this bed. I called 1-800-mattress and had to take the measurements and all the pictures of the mattress, only to find out later that they filed for bankruptcy and I believe Sleepy's was in the process of buying them. So I was referred to Simmons directly. I have to say that they were very helpful and started a claim. In three days, an inspector called and set an appointment up for the following week.

One week after the inspection, I called Simmons and was told that they were going to replace my mattress. "Great," I thought. However, in the letter that I received from Simmons, I have to pay them $85 for the mattress delivery and it has to be a money order or bank check as they cannot even process a credit card and they need a few tags from the mattress sent to them. Once they are in receipt of these items, then they will order a mattress for me. Are you telling me that there aren't any in the warehouse? I would love a freshly made mattress, don't get me wrong, but it sounds like a runaround.

In addition, I have to dispose of my mattress as they do not do pick-ups. I know that we are lucky that our bed qualifies for replacement, as so many other posters were not. But I bought a product, it is (as most are) defective and I have to pay for delivery and dispose of their trash for them. What about all those out there who were denied for stains? Who are they kidding? They don't even pick up the mattress. The consumer disposes it! I would really love to know the rationalization on that! I know this replacement will probably feel good for the first six months, then I will be on my way to a Sealy spring free!

We bought a Simmons Beauty Rest mattress in October 2007 from Fortunoff of New York. The purchase price was $2000.00. The mattress is less than two years old and is sagging. We followed the instructions by Simmons Customer Service to supply all the pictures required to evaluate the claim. We received a letter dated July 9, 2009 from Simmons stating that there was no structural failure in the mattress and that this was a normal body impression. When we tried out the mattress at Fortunoff, there was no give in the mattress.

As a result of their findings, Simmons is unwilling to offer a replacement. When my husband lied down on the mattress, he sinks into it. My husband has a heart condition and two herniated discs. This has aggravated the pain in his back and has to sleep in the guest room. Due to my husband's health conditions, we are forced to replace the mattress. It definitely won't be a Simmons. My husband is on a fixed income, so it will be a financial strain.

Sinking into the mattress is not body impression. If it was, why doesn't the mattress return to its original form? Why do you have warranties, when you don't honor them? A mattress life should be 10 years or more, not less than one. The mattress was sold to us with the information that it would be comfortable with proper body alignment.

I bought a mattress back in 2003. The mattress sunk in the middle to the point where recently I could not sleep on it. If you sleep on the side, you roll in the middle. I contacted Simmons who had an "inspector" come out. The inspector said the depression was 1 and 5/8 of an inch which is a defect. He said Simmons would get back to me with their final determination. They mailed me a letter stating that this is normal body imprints and that they would not replace the mattress. This mattress is useless and you cannot sleep on it. I have to buy a new bed now which is $1,800. I thought my bed would last at least 10 years when I spent $1,950 on the first Simmons mattress. Plus, I have been going to the chiropractor to get my neck and spine adjusted due to the pain.

We purchased Simmons Beauty Rest mattress from Value City Furniture-Niles back in November 2008. Since beginning, we were having backaches. I did some research on internet and most people say that your body needs to adjust with the new mattress; hence, give it some time. We gave time and until now the backache is still there. I called VCF-Niles and they had sent a technician to my place to check the mattress.

Then, I spoke to the manager at VCF and he said that he cannot get a return authorization from Simmons since there is no 2-inch deep thing to be seen. I told him that whenever I sleep in my guest room (which has a different mattress), then I am perfectly fine. It's only when I sleep on Simmons mattress. There may be no visual defect but there is definitely some defect somewhere. My health is going down day by day and due to lack of proper sleep, I am going under depression. I really need to get out of this mattress ASAP. I have spent $1000 on this and I want to get this straight.

We bought a Simmons Beautyrest from Ashley's in Jackson,Tennessee. The mattress had a defect when we got it home, so we had to return it to the store to replace it. When the new one arrived, we got it home and slept on it for a couple of days realizing that every night we slept on it, the mattress was sinking further down like we were in holes on each side of the bed and had trouble turning over. We contacted Ashley about the problem and they told us to bring it back and pick out another one.

We found one that we liked called a Plush Firm. We knew it wasn't real soft but it wasn't really hard either. We liked this one and ordered it to replace the one that was sinking in. When the new one arrived, we put it on the bed and realized that something wasn't right as soon as we went to bed. There was no plush to the mattress, only firm. The mattress had very little padding on the top and was very hard. It was not even close to the one we had tried in the store. The manager of Ashley came out and looked at it and agreed that there was definitely a difference and that he would do everything he could to help us but after talking to Simmons regional manager, his attitude changed.

We have contacted Ashley with emails and on the phone voicing our problem. We gave over $1400 for a mattress that we thought we would be sleeping on right now but we can't because it is so hard. Plush Firm does not mean rock hard in our book. The Simmons region manager told us that a mattress is like a pair of shoes, you have to break it in. We've owned numerous mattress in our lives but we never had to break one of them in. When you spend the amount we did for a mattress, it should feel and sleep like the one you test at the store you bought it from.

We were told that because other people try them at the store, they will seem softer than they are. Maybe they should put up a sign informing people of this so as not to mislead people. The lady at Simmons told my wife today that Simmons is not in the business of comfort; they are in the business of selling mattresses. Their customer service was rude and confrontational to say the least. If they think we're through fighting them, they better think again. We put some of the blame on all furniture stores that allow Simmons to treat their longtime customers or anyone this way.

Simmons told us that since all the serial numbers on the mattress matched the ones that go with building it, we received the same one we tried at the store. We are very disappointed with Ashley Furniture. We are longtime customers and purchase only their products. That relationship is most likely over since they've decided to stick their heads in the sand. It's a shame. They have good products. We did find the perfect mattress there the other day; it was a Simmons. Good luck to all of you in our shoes!

    1. Fraud. Fraudulent claims of how this mattress is to perform, providing “support and thus “provide an undisturbed and better night’s sleep and that will “improve my quality of life by getting a restful, comfortable sleep, and such mattress does not provide any such support, and sleep is disturbed within one hour of sleep, and it is impossible to get the necessary eight hours of undisturbed sleep, 2. Sleep deprivation, dizziness and damage to my health and well-being, 3. Damage to my spine and neck has occurred and continue to pop out of place, inflame, and cause a great deal of continuous pain from such sagging in short-term use and ever since delivery. (Manager told me I should roll to the other side and avoid the middle) 4. Value City’s failure to provide the center supports at delivery and installation (as seen on receipt) and comply with Simmons requirements for warranty, with Value City manager, Kelly Straight, claiming that I don’t need the center supports, when not doing so makes the warranty by Simmons void (Simmons Warranty division confirmed this verbally), and 5. This product is unusable for its designed purpose and as promoted due to the fact that this mattress sags within one hour of use ( not when just looking at it but when using it), and the only foreseeable way to rectify this problem is to either refund my money in full, including costs of delivery and install, or to exchange with another manufactures new mattress of equivalency (American Signature is Value City’s brand), and as soon as possible to avoid further harm. Please let me know if you need any other documentation. Thank you so much for your assistance in resolving this problem.

Those complaints as well as mine involve sagging and non-action by the 3 companies involving warranty claims. They all seem to follow the same pattern and I would wonder if they are in collusion with each other. They all use the same tactics to get out of their full replacement warranty. I also understand (from a local mattress store owner)that some of the mattress companies have such a bad product that they are going to one year warranties. Additionally during the 20 years he has owned the store prices have stayed the same and the product has gotten cheaper. Mattresses are a huge expense and people can't afford to replace every year. They also are a large health problem with back problems etc.

We purchased a Simmons Pillowtop Exceptionale mattress in July 2007. Within weeks the mattress developed body impressions that worsened until by December 2008 my husband, who has had lower back surgery, was sleeping on the couch to avoid pain. We took photos of the 1.75 depressions, which Carlsons assured us qualified for a replacement. The mattress has a 10 year non-prorated warranty. The hitch is that I didn't save the obnoxious law label that was attached to the top of the pillowtop. I retained the wrong tag, which contained the same information regarding the identity and origin of the mattress. I do not believe that this stipulation would hold up against any state consumer protection or FTC laws. I also believe that the huge number of complaints regarding the pillowtop mattress failures and stonewalling tactics by the industry warrant a massive class action lawsuit. My husband and I now both suffer from chronic back pain as a direct result of this mattress. Any attorneys out there who want to take this on? This is beyond the limits of intentional infliction of pain and suffering!

So, I called customer service (Lisa Scorziel, Pres. of Banner) and after much arguing, she sent out a mattress inspector. He measured for body impressions with a string he pulled across the bed and took pictures. The report came back complaint unfounded. But he did report that I had a non-matching box-spring. Lisa never looked into this claim. I told her the bed had sunk where I lay and I want another mattress. So after many phone calls and debates with her; she agreed to give me a warranty replacement. I got the replacement and the mattress is FIRM and hurts my back. It has a tag on it claiming to be a Hutson, but I know it's not. Then, Lisa claimed that the crossbar in the bed frame was probably making it firm. I took the crossbar out and of course, as I suspected, this made absolutely no difference. I purchased this $1,151 bed set with my charge card and filed a charge dispute with my charge card co. This has been a nightmare. This is my 3rd and last Beautyrest. I never had problems before and the mattress always wore out and never had to make any claims. What has happened to the quality? Never heard of a bed tek until now, what type of gimmick is that? We purchased a mattress set from Art Van. They did not have the mattress in the showroom in a King that we liked. We wondered into the Clearance Center and found the one we wanted. It could be delivered in 2 days. We purchased the mattress and Bed. We were asked to purchase the additional 1 year service plan on the set (mattress and frame). We declined because Simmons mattresses come with a 10 year warranty and did not feel that spending additional money to cover a frame was warranted. We were told that we would not have Art Van's satisfaction guarantee, but again Simmons has a warranty.

The mattress was constructed in Sept. 2007. We purchased it in January 2008. It is now July 2008 and for the past month we have been sleeping in HOLES. The dips are 1.0 inches when taking a straight edge and measuring down, just like it shows on the Simmons website. When you lay on it, the dip becomes 3 inches. I contacted Simmons and they said I had to contact Art Van. Art Van said that since I did not buy the one year plan the mattress was not covered. Mattresses have a 10 year plan so how would not purchasing a 1 year plan make a difference.

I was told by the service department that the clearance center item was sold as is because it was on the floor and not the warehouse. I asked them to make sure that they updated their statements to cover the fact that the manufacture's warranty was also not valid because all it states is that Service is Not Available and the Total Satisfaction Guarantee is excluded. The document DOES NOT state that the Manufacture's Warranty is voided. I do not want to return the mattress for something else, or for cash. I wanted a replacement. Now when we can afford it we will have to purchase a new mattress and it will not be from Art Van nor will it be a Simmons.

The new mattress was purchased to replace a mattress that was 8 years old and started causing back pain. For the first month and a half my back felt better. Now that I am sleeping in a 3.0 inch dip of the mattress my back pain has returned and I hate to get into bed at night. We will have to purchase another new mattress and still have the payments on the one we currently have and cannot use.

Simmons sent out an independent inspector to inspect the mattress. The first comment when he walked into the bedroom was, Wow you guys are sleeping in a ditch. The sag is quite apperent. The inspector brought out his camera and a plastic guage with inches on it. He stated that it was over the 1.5 inch requirement to be replaced. He stated that he would turn it in as a factory defective mattress as well. There was a small tear on the bottom cover of the mattress. This mattress is a no flip mattress. He took a picture of this small tear and said that it was his job to report the entire picture of the mattress, understandable. This small tear was caused by a wire or staple sticking out of the mattress the first time I turned the mattress. I hammered the staple/wire back into the bed and thought no further.

The inspector took maybe two pictures of the sag in the bed and stated that it was over the limit of normal sag. There were deeper sag points but he said this should be sufficient. My warranty claim was turned down due to the tear in the mattress and due to the fact that the picture provided by the inspector did not show over 1.5 inches. I appealed the warranty finding and they stated that if I would send in additional pictures of the sag they would reconsider. I took pictures showing over 2 inches of sag in the bed. Keep in mind that I weight 165 and my wife weighs much less. Once again I was turned down and was told that nothing that I could do or say would make a difference on the issue. The manager who I spoke with did not even know who I was when she told me this. She told me that she would have to pull my file. Obviously this was going to be the final word before she even knew who I was. This is roughly a $2000 mattress with the longest warranty available from Simmons. From the research I have found I would say a class action is in order to stop this abuse of the consumer. All I want is for them to stand by their warranty but it sounds like they could come up with a reason to deny just about every claim.

$2000 mattress will need to be replaced. My wife has a bulging disk in her back. The doctor says it was caused by the mattress.

We bought a Simmons Beauty Rest mattress about 4.5 years ago. We liked it very much at first, our favorite feature being that we could both move around or get up without disturbing each other. We are both restless sleepers so this is an important feature for us.

However, almost immediately, we started noticing body impressions. The bed sags where we each sleep and there is quite a noticeable hump in the middle between where we sleep. We decided it wasn't too bad as we both liked the way the mattress stays still even when one of us is restless.

However, as the months passed, the body impressions got deeper and deeper. Now when you are lying on the bed, it feels like you are sleeping in a hole. The impressions are even clearly visable when the bed is fully made up.

We called Art Van (where the mattress p>was purchased) thinking we would get some help since the mattress is still well under warranty. They sent out a technician who proceded to check the mattress for stains (which would apparently void the warranty! Luckily we keep ours covered with a heavy pad) and to measure the depth of the indentations. Apparently (when no one is lying on the bed) our 'body impressions' are about an inch deep. This is considered NORMAL! According to Simmons the impressions must be over an 1.5 inches before this is considered a defect. Please know this: When lying on the bed, you sink. Reguardless of how deep the indents are when no one is on the bed, sleeping on this mattress is like sleeping in a hole.

After paying almost $2000 for a king size mattress, we expect it should last more than 5 years. In less than 5 years, this Simmons mattress has become lumpy and uncomfortable, creating back problems.

Now every morning we wake up with back pain. We are going to have to search for a new mattress even though we just finally paid this one off last year!

I bought a queen Simmons Back Care Esteem Pillow Top mattress. I spent over 1K on this about 5 years ago. The store that we bought it from went out of business before the year was up. I called Simmons because less than a year had gone by and we had fox holes. They sent out a person to come measure the depressions. they were slightly less than 1.5 inches each. They said they were okay and so no offer was made to help or any ideas as to how to fix the problem.

I tried buying extra foam pads to go on top (sheets won't fit over that) now we are on the hunt for a new bed, less than 5 years out. Too Bad, Simmons, Not buying another one.

Lost over $400 and now have to buy another mattress.

We were using the crib and when we changed the mattress level, the inferior plastic supports for the mattress broke at 2 different levels. Luckily the baby was not in the crib at the time. This is very dangerous. Please advise!!!!

We now have a worthless crib! How many babies have been injured due to someone deciding that plastic hooks would hold babies?!

Mattress sagging on sides. Simmons policy states it must sag 1.5 inches before they can replace. We've had mattress one year 5 months, but problem started about 6 months ago. They sent tech to house who took measurements and pictures. How can you tell how a mattress feels without lying down on it. The mattress does down about 6 inches when you lie on it. We feel like were sleeping on the side of a small hill. They declined our claim. This is the second mattress we've had problems with from Simmons. We should have learned from the first mattress.

I purchased a Simmons mattress in 2001. After 2 years the middle of the bed started getting a hump. I went back to where I purchased it and they made me give them a check for $100.00 (Mattress disscounters)in case the mattress had a stain. Well a man came and checked the mattress and a week later I received a letter telling me the hump was less than an inch and they would not be replacing it. Well a few years has pasted and the hump has gotten bigger and where you lay feels like you are laying in a hole. If you try to move over you are rolling up a hill and you slide back down. My husband has put a piece of plyboard under the mattress this helps a little.

A few weeks ago I called Simmons directly they sent another man out to check the bed, this time he took pictures of the mattress and said it looked pretty bad to him but he only worked for bed check not Simmons.

Well today I received a letter from Simmons. this is what it said. Thank you for allowing us the opportunity to assist you with your Simmons product. Simmons offers a limited warranty and strives to be as fair as possible when evaluating warranty claims. In assessing your claim, we found no structural failure in either the mattress or box springs/foundation. In addition, the compaction of the panels in this style of bedding is to be expected. The compression does not affect the product's durability. As with other beds of this type, the thicker and more luxurious the filling materials, the more susceptible they are to compaction. Please note that this should not be considered a defect. The mattress is contouring to the shape of your body. As a result of these finding, we are unable to offer a replacement because the product is performing normally. We appreciate you giving us the opportunity to assist you.

So as you can see Simmons says that if you buy a new mattress, buy the cheapest one they have, because if you buy the best one you will sink in 2 years and have back problems.

We purchased this mattress because the salesman said it would last a long time and the swedish foam would last forever. How can Simmons say this is normal of high quality mattresses? We paid $1,600 for this mattress and expected to have a good mattress for more than a couple of years. I thought that Simmons was a good company but I guess I was wrong if this is how they treat their customers. I just want them to fix my mattress or replace it. What good is a warranty if the company treats you like this.

Six years ago we bought a Simmons King mattress-nobility firm. After 3 years we weren't sleeping well since the mattress 'caved in on the edges' where most of our body weight was displaced. Robinson's-May had closed and we thought we had no recourse even though our mattress was under a 10-year warranty.

We then learned we could go direct to Simmons for help . This required taking pictures of the mattress to show we had a 1/1/2 inch depression. We measured over an inch depression took the pictures of the mattress, gaping holes where the mattress handles 'pulled out' and waited for response. For a mattress that is supposed to be 'firm' it is flimsey and can be easily bent. We have the original sale papers and diagram showing us how often and in what way we should turn the mattress, which we did but it hasn't helped.

We received a letter saying they were unable to offer a replacement having found 'no structural failure'. Admitting in the letter that 'today's' products are more upholstered than they were a few years ago it is not an indication of an inferior product.

I am 65 years old and my husband is 76 years old and we do have back problems which are aggravated by our mattress. Yet Simmons won't stand by their product in good faith and are 'nit picking' for parts of an inch.

I bought a crib from Simmons Juvenile Furniture about 2 years ago now. Last night, my son woke me up as little ones do, just b/c he was fussy. I lowered the side of the crib, as I cannot reach over the top of it, took my son out and rocked him back to sleep. I then walked over to the crib with him to place him back down, when the whole lowered side of the crib broke and fell off. I was barely putting any pressure on the side at all, as I was holding my son.

I woke my husband to see if it could be fixed or if it was a mistake I made. It turns out that the whole plastic piece on the right side of the crib broke off and went flying across the room. Thank god my son was in my arms and not standing at the crib when this happened as he would have fell right out of the crib. I did call the company today and got the part replaced for free (with a bit of a fight) and they said it would take 7-10 days to get the part. I complained about that too, as where is my infant son going to sleep for 7-10 days?

Now my concern is as my son is growing older, children are known to bounce on the beds, holding the rails and stand and pull on them, what if it breaks again?? We did nothing to have it happen this time, imagine if my son had been a jumper? He would have flown across the room. The make of the crib is a Simmons model number 239180 04-289. I am nervous now for my son in this crib, but I dont have the money to buy a new crib. I see a lot of sleepless nights ahead of me for a while.

We purchased a Simmons Beauty Rest, Pillow Top,Back Care Ultimate mattress approximately 2-3 years ago and have taken excellent care of it (flipped mattress over and also top to bottom every 2 weeks per instructions). No matter what we do, the mattress sags in the middle. We went to the store that sold the mattress set to us (John Eye Big Sandy Superstore); they gave us a complaint form to fill out and mail in.

We did this and after several weeks, they sent us a letter and asked us to contact Simmons Company. We sent the information to them which they did not accept; we had to fill out their complaint forms. We did this and several weeks passed before they sent us another letter saying we had to take pictures of the mattress set and instructions how to take the pictures. We did this and mailed the pictures to them. After more weeks passed we received a letter saying they found no structural failure in eith the mattress or box springs.

They said compaction of the panels in this style of bedding is to be expected, and that the mattress is contouring to the shape of our bodies. They said they were encouraging us to turn and rotate the mattress every few months to minimize the impressions??? We have done this all along. To summarize their letter---as a result of these findings, we are unable to offer a replacement because the product is performing normally.

Today, July 25, 2005, I called and talked to Casandra at Simmons Company. It was unbelievable the way I was treated. She said if I wanted to wait 90 days I could start the complaint process all over again; send paperwork and pictures again. When I told her I could send a xerox copy of what I sent before (it had not changed), she said it would be refused. She also said the pictures could change in 90 days. I asked her to send a representative to our home to see for himself or to test it out. She said, we don't have a rep in your area and besides they wouldn't lie on your bed. I then asked her to send a truck by and pick it up which she thought I was being ridiculous. When I asked to speak to owner, Charlie Itell, she said he wouldn't answer my call and a letter to him would be returned.

I purchased a Simmons matress and matching box springs from Heilig Meyers of Keyser, WV ( who is now out of business) in Sept 1996. At the time of delivery the delivery persons said that my bed which consisted of a wooden headboard and footboard with side metal rails and 3 wooden slats was not enough support. At that time I went back to the store and asked what bedframe I needed to be covered under the warranty. I was sold a metal H type frame and told to use the 3 slats along with it. Appx May of 2002 the mattress started to lean sidways in the middle. By this I mean it literally leaned out on one side and leaned in on the other side about 3-4 inches from the bottom.

I checked a few consumer sites on the internet and quickly became concerned from other complaints that I would not receive any claim satisifaction from Simmons. I called Simmons and they sent me a 4 page claim form, which I filled out and returned along with my Purchase invoice, and per claim form about 8 pictures of the box springs, mattress, and frame.

I received back a letter that says I do not have the required frame and slats for this matress set. According to their claim form and the pictures of the types of frames, I feel that what I was using and what was recommended from their sales representatives (Hielig Meyers) and the price that I paid for the best mattress set and warranty that it should be covered no questions asked.

I purchased a queen size mattress from this company on 9/4/2000 and spent $985.06. I noticed in the beginning of March 2001, that the center was compressing. I contacted the store who instructed me to contact Mattress Pro's to come and inspect the mattress. From my understanding, they said nothing was wrong and flipped my mattress again. I am unable to see a copy of their inspection report. Even though I had flipped the mattress according to their instructions, now the other side is also compressing. I have contacted Simmons coporate offices on 2 seperate occasions, and all they keep telling me is that there is nothing wrong and to flip my mattress. As I stated earlier, I can not flip my mattress since both sides are compressed. I was under the impression that a mattress should last approximatly 15-20 years, not less than 12 months. They are unwilling to stand behind their product.

I am now having to spend additional funds to replace a mattress that was purchased less than one year ago. I find this completly unexceptable.
