On or about October 13, 2009 I called BSI after my refinance loan closed to request my escrow funds being held only to pay my LA County taxes. On or about October 27, 2008, my mortgage servicer BSI Financial Services, knowingly and "illegally" sent my escrow impound reserve payments in the amount of $2,246.62 to CentralBanc Mortgage Corporation under the pretext that this was part of closing. It was NOT. The HUD-1 Form does not show any line item for these fund and I was never told or agreed to such. BSI received these funds from my monthly mortgage payments. I paid with instructions that they should pay my LA County taxes only. These funds were NOT part of my September 2008 refinance. BSI already knew this because CentralBanc paid off my loan to them in September 2008. So they had no business sending Central Banc my money long after my loan closed during September 2008. BSI only had an obligation to: pay my LA county taxes OR return the money to me OR transfer those funds to my new escrow account with CitiMortgage - my new loan servicer. BSI had a fiduciary duty to me - the law required them to return these funds to me within 30 days. I have repeatedly requested my funds be returned. Yet, they tell me my money was sent to CentralBanc. Well that is not my problem, it is BSI’s problem. BSI owes me and they must pay me. Thank you. More
