After trying to reach my assigned asset manager for almost 2 weeks, I was told by a customer service agent that she was no longer with the company. A week later, I called to get more information concerning my loan and to ask for clarification of a point that was ambiguous, and the newly assigned asset manager that I spoke with was incapable of comprehending my question, spoke so quickly that I couldn't understand him, and became quickly insulting. I tried to explain that I hadn't heard from the former asset manager and had been told that she left the company when he interrupted me saying that she still in fact worked there but that it was not her role to 'speak' with customers. This surprised me as I had had a number of conversations with her previously; therefore I asked to speak with his supervisor.
He responded that the issue did not need a supervisor, that all I had to do was sign and return the requested document, that it wasn't necessary to answer my question. I asked several times for the name of a supervisor and still he refused, telling me that I was wasting his time and that if there was nothing else, he would need to hang up. If this is the type of employee that this company employs, it doesn't bode well for us as customers. This company does indeed need to be thoroughly investigated.

This company is terrible! CENLAR sold our mortgage to Bayview and I have never dealt with such incompetent people in my life. No one knows what's going on with the account. Each person says something different. Awful! This worst part is, we have no choice but to deal with these people. If you have any brains, do not give this company the time a day. I want to take a crap on every person I've spoken too.

I owned a home and had a mortgage with Wells Fargo. Husband died in 2009 and WF didn't want to work with me. Moved out of the house in November of 2014 and informed WF I was walking away, as per my lawyer's instructions. Now I get a letter (over 2 years later!) from Bayview saying they took over the mortgage??? Can they do that with a house in foreclosure? Since the original mortgage was in my husband's name only, I know they have no recourse with me, but I don't need the aggravation of having to deal with some fly by night operation regarding a house I let go a long time ago.

Worst company to deal with. Unprofessional service reps. Add charges to your monthly statements without notifying you or explaining to you what the charges are for. Charges are also added without approval. Pictures are taken of your home without notification or signed approval. Then they want you to pay for it... WRONG. My mortgage was sold to Bayview - this was not my choice - this company should be no one's choice.

My loan was sold to Bayview loan in 2013. In April 2016, due to a lapse of 2 days in my hazard insurance, and my insurance company in not reissuing the insurance information, Bayview put an escrow account on my loan. Full disclosure, my mother passed away on March 2, 2016 and I was the executor of her estate. Between settling her estate and a full time job, I did not pay attention to my loan. So I made 2 payments in Sept and Oct thinking that they were late payments. It was in November that I realized they had put an escrow account on the loan and even though I didn't request this, it took a letter asking them to cancel the escrow account, which I did in late December.
I paid December, however they applied my payment to a "suspense" account. I called on Jan. 13th to make a payment and was informed that if I made that payment, that it would go to the "shortage" to the escrow account. Currently they are asking for $2,234.99 lump sum for my "shortage", even though I have contacted their insurance department and they state that I owe $14.15. They also harass me daily, starting on the 2nd of the month for my payment, even though I pay by the 15th of each month. They are crooks and should be investigated.

Can we get a lawsuit going. I am so tired of the harassment calls when I am not even late. I pay my mortgage by the 15th of every month. Something I have done for 26 years. Bayview calls and want it on the 1st of each month.

I had my mortgage with Bank of America for years with no issue. Last August 2016, the mortgage was sold to Bayview Mortgage. A month later, my payment was increase by $56 saying my escrow was short. I spoke to customer services many times with no help. When I contacted Bank of America, I was told everything was transfer. After getting their monthly $56 for a year, I received another later saying my escrow is short $1100, so my mortgage increases by over $100 plus the increase in tax and insurance. I called customer service twice and was told a bunch of BS. I asked to talk to the escrow department and was told they don't have one, they don't have any department that can help. Next month, I will pay them just the principal and interest, then I will take care of the tax and insurance. Bad COMPANY TO DO BUSINESS WITH. HOPE THEY GET SERVE, SO EVERYONE LIKE ME CAN GET OUR MONEY BACK!

We first had our Mortgage with Guaranty Bank for many years, then they sold it, once we refinanced it in 2014, to BSI Financial. BSI had it for about 2 months, then they sold it to Bayview around Oct 1st. BSI, sent us a statement telling us that there was an Escrow Shortage and that we had 3 payment options. If we wanted to keep our payment low, we could pay off the Escrow in full so we did.
Well, when BSI sent the payment to Bayview, something went wrong, because now Bayview is asking for double payment on the Escrow account. I have spent hours on the phone calling numerous numbers and all you get is these automated services. I have faxed them a copy of the Check that shows the amount for the Escrow payment, nothing. We have received letters stating they will look into it. We just got the Dec statement showing the regular payment with the extra added Escrow payment, so they want us to pay $80.04 more a month on our Escrow. I don't know who is this company? Where did they come from? I was not aware that the first company was even thinking about selling our Mortgage or why would they sell it. What can we do? Is Bayview a Collection Co.

My mortgage loan was with Citizens Bank (citizens one) and they sold it without my knowledge to Bayview Loan Servicing. Apparently, Bayview acquired my loan in September 2016. My August payment was made to Citizens as usual. On September 6th I received a statement from Bayview saying that I owed two months of mortgage payments; which is impossible since I was current. I called Citizens Bank to ask what was going on and was told they sold the loan and "it was just a business decision." I called Bayview and was told they would clear up the billing error. I always paid my mortgage online with Citizens, so I set up the Bayview online account. The information on the online account never changed, so I waited for the next bill which was a collections bill threatening default! I began receiving two letters every week for three weeks. The letters contained a number to call.
Each time I called before 4:00 pm EASTERN TIME, I received a recording that their office is open between the hours of 8-8, please call back during normal business hours! I called two different numbers from two different correspondence and each time received the same voicemail message. I attempted to use the online account I had set up but kept receiving a message that stated "An error has occurred, please attempt to access your account later." I then looked up Bayview on the internet and was able to find a different number on their website. It was a recording that asked for SS# and other person info. I was so frustrated at this point that I typed in all the information. I requested to speak with someone from the customer service department about billing. I was connected to a man (Jose?) and repeatedly tried to explain the billing error (I have a doctorate degree, I know the communication problem did not lie with me).
He kept saying, "I don't know what your September bill says but you have not paid your bill; are you going to pay your bill?" After numerous attempts to get him to look up my billing for September he said "What are you trying to do, we didn't receive your September payment," he could not have been more rude! Since I believed that I was speaking to someone in the customer service department and wasn't getting anywhere, I asked to speak with a supervisor. He then very rudely said, "You want to speak with customer service?" I stated that I thought this was customer service and to please allow me to speak with a supervisor. He said, "This is the Loss and Mitigation Department because you are in default." Very frustrated now, I asked to be transferred to customer service. I asked about my bill and was told that that my August payment to Citizens must not have cleared before they acquired the loan.
I asked for this to be corrected and was told it would be. I asked about not being able to use the on-line account, as I wanted to see if the correction was really going to be made, but was informed that they have disabled the online account, which is a routine practice when the loan is delinquent! I have never had such a bad experience. If you are able to get through the recording says "You have reached Bayview loan servicing, a debt collection company." I have been paying my mortgage for 22 years and very angry with Citizens Bank for selling it to this awful company. The service is the worst! I just read a couple other reviews on Consumer Affairs about Bayview and now realize that there are other people in the same situation that are still unable to clear up the billing error after many months. If my new statement arrives without the billing error cleared, I am going to post this message EVERYWHERE!

My home mortgage was sold by CITI to Bayview without my knowledge. I received a letter stating that it had been taken over, but I didn't need to do anything as all my information had been transferred. For many, many years instead of making a monthly payment, I make 2 payments that are deducted from my bank account. These 2 separate drafts total $64.00 more than the scheduled payment. I received my first call last month stating that I was past due and needed to make a payment to be in good standing. I advised them, they were deducting my payment themselves and needed to check their records.
They called back, apologized and said they thought they were only approved to withdraw one of the two payments. They had me make a verbal statement that I approved for them to make 2 even withdrawals on the 1st and 15th and that would handle everything. This month I received a call stating that I was behind again. I told him, I wanted to speak to a supervisor, that I had handled all this last month. He refused and I hung up. What kind of Mickey Mouse organization is this? Can our loans, especially those as important as a mortgage be bought and sold without our approval??

I was in the process of a loan modification with kyhc since my bk had been discharged back in July '16. I contacted Bayview and spoke with a Vanessa **. She stated that since my case was in bankruptcy they couldn't provide the information. I explained that is not true and, "I can send you the discharge documents." After going back and, forth she told me to have my attorney speak with their attorneys. This was done and, their attorney even request the statement from Bayview. Because of incompetent people you deal with at Bayview my loan was denied! I would like to sue these ** for causing this hardship not only to me but most importantly my family!

Our mortgage loan was with CITI and they sold it without our knowledge to Bayview Loan Servicing. Bayview acquired our loan on July 6th 2016. Our June payment was made to CITI as always since they send us a statement each month. Mid July we get a statement from Bayview and I thought it was a con. I called them to make sure they were up and up before I sent them a payment and then called CITI to verify they had sold it. Bayview said we owed for the month of June and that is why our statement reflected two payments. I told them that our payment for June was sent to CITI and they said we should have sent it to them at Bayview.
I asked them how is this possible when they did not even acquire our loan till July? And never got a welcoming package as I was told by the agent at Bayview we were told was sent out to us. (They ended up sending one out after our conversation.) They just gave me a bunch of double talk and not a straight answer. My Husband and I have had to call Bayview several times each month and each time we get the runaround and told anything to get us off the phone. Two months ago I spoke to an agent at Bayview that told me if we could prove we paid CITI the June Payment all would be okay and they would stop harassing us over the back payment. I faxed the copy of the cashed check given to CITI for June's payment as directed and it took another month and several phone calls before someone at Bayview admitted they had received that information. But they have never removed the charge from our account with them.
When we talk to them now they are saying we owe for the month of February. These jerks never even had our loan in February and we never missed a payment to CITI ever never ever and we have the statements from CITI to prove it and yet Bayview continues to say we are owe from when CITI had our loan. Bayview has ruined our credit rating with this and will not get it right. We continue to fight with them over this and nothing is being done about it with Bayview.

I did a loan modification with Bayview and it took over 9 months to get it done and while we doing it the man at Bayview who was doing our modification told me not to make any payments until the modification was done, which I did. Now they report to the credit bureaus that I was more than 90 days past due on 3 different times. Now my credit is screwed up and I can't get a loan.

Many violations have been done such as failing to give me written notice of service, forging documents. M&T and Bayview Loan Servicing told me to send certain documents several times. They told me they didn't receive documents that I know I sent. They failed to send letter dated within five days acknowledging they received the documents. They constantly robocall, and on and on. Meredith ** (of Phelan and Hallinan) told me she wanted to help me and called me several times saying she worked for your court.
According to court records on 7/30/2015 Property Sale Cancelled as directed by Hallinan. Notice of cancellation **. On August 27, 2015, two plain dressed men broke into my house at 9 in the morning. When I asked them who they were they wouldn't tell me. When I asked them to stop, they would not. They were loud, insulting, and sought to intimidate me. I had to call the police, (there is a police report **) only when the officers came did the two individuals sent by M&T Bank stop cursing at me.
By then, my lock was broken and my door was damaged. My son, 7, was terrified. Neighbors were alarmed. This ugly uproar went on for two hours. A letter written August 28, 2016 from Bayview Loan Servicing, states that "We have received your loan workout package". For the summer of 2015, I was in constant contact with Bayview and M&T Bank and I have several other letters to prove it. The inspection stating my house was vacant was a fraud. There was never any doubt that this house was occupied by (me) its owner. What happened on August 27 was is a home invasion, followed by harassment, threats, slander, and property damage. It’s six months later they haven’t address anything. I have a right to have peace in my own house. M&T and Bayview have no promissory note to my house. Chase does not know where my promissory note is.

I call to make my payments with a rep and there has been an instance where the rep took what he wanted and upon giving me the confirmation number I repeated to him three times the amount that I authorized and he said, "No, I took more than that." So I demanded a Supervisor whom I was on hold for almost two hours. She promised I would get the difference back. She insisted on a wire transfer. I have never done a wire transfer so I did NOT know my bank charged a fee. The Supervisor should have said that. So I had to call back and I called to speak to a Manager and I did get to speak to someone whom stated they were a manager. She stated that she will have a check issued to me.
Well here we are several weeks later and no check. I called and spoke to a third supervisor and she stated that she has no idea of how long it will take. So now when I make my next payment I feel this will happen again. This is one of their ways of stealing your money from you. I will be glad when my mortgage is paid in the next few years so I do not have to deal with Bayview Mortgage EVER Again!

We are going to lapse in Homeowners as of tomorrow. I received an urgent email from our agent last week that they had not been paid by Bayview for the annual premium. I immediately called Bayview, who informed me that this loan does NOT have Homeowner's in escrow - only property taxes! He then read out his most recent statement as to how payment is disbursed each month. That was August. I read him MY statement I received from June that showed $140 more going into escrow and that covers the homeowners. I had to then fax them the Declaration page, and I added the cancellation notice, the email from State Farm, and their own statement showing the disbursement that includes monies for homeowners. The agent said once that was done, it would be paid.
Of course it did not happen that way. Yesterday State Farm called to say they heard nothing and received nothing. We cannot afford to pay this amount and should not have to. After THREE hours on the phone, being transferred to 4 different departments, they steadfastly remain that the mortgage has only taxes in escrow. I finally stated that "BAYVIEW HAS CHANGED THIS MORTGAGE WITHOUT KNOWLEDGE OR PERMISSION. This is a contract and as such you have now breached a contract." They could not or would not even get me over to the escrow department! "We don't have those numbers." I gave the agent the number from the back of their own damn monthly statement. After 3 hours all I got is that they are going to run an "escrow analysis" on this account and I am to call them in 2 days to find out the results. **!! The insurance lapses on that same day and they need to receive payment today to process in time.
This is the final abuse from BOA-Countrywide-Greentree-Ditech-Bayview. We already won $1680 in the class-action against BOA and Greentree, but they will not allow us to use the proceeds as needed, instead tacking it on the rear of the loan! I find out that for those who HAD already been foreclosed on, they received a check. To me, this action proves it is OUR MONEY and they are literally robbing us of our just retribution.
Ditech threatened to foreclose over $27 last year (See "A Leopard cannot change his spots"), yet here they are holding $1680 of our money. Now with the turnover of servicing to Bayview, suddenly our loan, which was modified in 2014, seems to have mysteriously been modified again. This modification, by the way, by law or provision put down by HAMP demanded that the mortgage have property taxes and insurance placed into escrow. I hated it, fought against it, but was FORCED to do it. Now it seems Bayview can arbitrarily change the terms of a loan.
I say not and will call foul. This is the end of the line, probably the end of our home ownership, but we will not go down without a fight. We are seeing an attorney next week to find out what action can be taken to force them to be accountable. And I will continue to warn others via this forum of the ultimate in corrupt and contemptible practices from these criminals. And that includes all from BOA to Countrywide to Greentree to Ditech to Bayview.
We had this mortgage since 1999 -- We are all honest people on this forum trying to do the right and responsible thing, but we absolutely do not stand a chance against professional finance criminals such as these. Nor do we seem to have an advocate. If ANYONE knows of how to reach an advocate, please respond to me. To have to move and lose the last shred of basic human needs will be the straw that breaks my neck, but I (we) are so tired of the now 7 years of fighting these miscreants that one tends to be driven to the extreme.
Lastly, I still contend - If WE break terms of a contract - that is considered a breach of contract and therefore renders it null and void. But I wager that is tort law. Banks and finance companies run by their own self-created set of laws. UNREGULATED! But it is exactly what Bayview has done - broken the terms of a contract and therefore a breach of said contract.
If this is how the new WOIA (one excuse used as to why no one contacted me for 3 months) and the TTW participants are assisted in this state (or this region) this will be a worse fiasco than the health care debacle by this state. I will take it to the next level. I do not expect much from NC, but I do expect SOME respect and an advocate of sort because I am trying to become a productive member of society again! I am 57, and my time is running out in more ways than just the ticket's status.
I must make SSA aware of this due to the time my ticket has actually been unassigned. This may cause irreparable harm if I do not. In the meantime, I am still trying to find employment by the online job banks. All I receive are calls from recruiters with temporary assignments for skills I do not possess. Right now, I literally do not know what to do, or whom to turn to for advice and assistance. I had always been an advocate for everyone else years ago, now I need an advocate and one with an aggressive plan. I intelligent, I am educated, I am NOT lazy, and I do not WANT or expect entitlements. I want to be able to support my family again and have pride. I have been kicked by so many agencies in NC in the last 6 months alone that it makes this struggle nearly impossible. Dear Ombudsman staff, you tell me if there is any help or should I simply walk away; admit defeat, and give up all hope.

We are trying to do a loan modification. I fill out all the paperwork and send it to Miami. Tommi the person working with our account scolded me for sending the documents to the address on the letter. Then she "left". I get another asset manager and he has me forward everything... again. This week, I got papers sent to me from Bayview via FedEx... The papers indicated that I had liens and judgments against the property and that I had to rectify them before the three month trial was over or the modification would not be approved. I called Adrian my asset manager and he confirmed this. I was so upset because I knew we did not have liens or judgements.
Another "red flag" was that these liens and judgements were only in my husband's name... not mine. We began researching public records (for free) and found all of the legal documents and none of them matched our address, city or anything. The men listed had the same name and Bayview just tagged them on us... as if we are not already struggling... Over $100,000 of judgements and liens and judgements were credited to us by Bayview. I am not happy, and I am going to have an attorney (that I cannot afford) look into this. If I, a laywoman, could find these records why couldn't Bayview? It is a ridiculous shame how companies kick folks when they are down. I'm not going out without a legal proceeding. They can count on that. Their best bet is to go ahead and approve my loan modification and not play games if they don't want a legal rainstorm to pour down on them.

Very unethical business. They purchased my mortgage 5 months ago and it has been nothing but problems since. They opened an escrow account even though I pay my taxes myself. They have the letter I sent asking the escrow account be closed along with proof of paid taxes. They have the letter but not the tax receipt. They will not apply extra money to the principal and customer service can never answer any questions. Letters go unanswered. They want to charge me to get a payoff amount. DO NOT DO BUSINESS WITH THIS COMPANY!!

I understand that banks are regulated by federal government, but is Bayview Loan Servicing not regulated at all. They request illegally that documents be altered after all parties have signed, seller has requested over 20 times verbally and in writing that they send a confirmation in writing to her for each and every document she submits. They have verbally refused to do this. And continue to claim that documents sent and verified received are constantly lost or as one idiot stated "we delete it upon receiving the document otherwise we would be drowning in documents". They will for instance hold up the file for 30 days an estimated HUD statement and suddenly claim that the full company name was not spelled out on it, so they delayed the whole short sale process for 30 days.
It has been 5 months since we submitted the offer and they keep claiming that next week they will have an answer and "it is going into underwriting today as soon as we get one more tiny verb misspell on this scratch paper corrected by the buyers". Or "your signature looks more like an initial. Can you change your signature to look like a normal signature." And there goes another 30 days. We have submitted two full priced offers and now a third one - all of which have cancelled due to their ineptness.
I know of one asset manager who has been fired from several servicing companies only to land at Bayview. This woman has destroyed so many lives. I'm sure she is greatly admired by the banking institutes. It appears they can harass, intimidate, break laws and do whatever they want. Nothing is regulating them or holding them accountable for how they manage other peoples money. I need to short sale my house. I need to get out from under this nightmare. Had I know my loan was to be serviced by these neglectful, abusive tyrants I would have never refinanced. They keep holding up my short sale. In the meantime interest is racking up on my mortgage and I am pretty sure this is the reason for their absurd delays. How many people have committed suicide just dealing with these entities acting as asset managers.

My current loan was sold to Bayview by Bank of America. I am in the process of a Refi with my credit union; however, the CU has been trying to get payoff and loan transfer verification since 4/5/16. When I called to follow up on the behalf of my CU - the customer service rep stated there were 3-4 requests. No way can you speak with a supervisor to escalate... One way in and no way out... I only have a 30 day rate lock, but the way Bayview's service is - I may miss out on the rate. Shame on Bank of America for putting customers like myself in this position. Bank of America always wondered why I wouldn't reopen a checking or savings with them. This is just another reason why I will never do banking with Bank of America.

I am seeking help with my current lender. Feb. 2015 we opened escrow to assume the current mortgage on Parker ave., Oakland, CA. 94605. We were granted approval Sept. 2015. I have not heard from Evelyn ** (Dept. Head) since Nov. 2015. We wired closing funds and documents March 2016. We still have not recorded and conveyed the Mortgage and title to us. I have exhausted the customer service loop which always leads back to Evelyn ** voicemail. We have been perhaps too patient, but 15 months for a simple Assumption is excessive to say the least. We simply want what we already paid for, our current Mortgage.

Our loan was sold to Bayview a few months ago. It's been a disaster ever since. We are attempting a loan remodification however, the asset manager is unobtainable. I leave emails, voice messages, etc. When I sent all of the documents (approx 3 hrs of work), I did so via certified mail and sent it to the address provided (Miami). When the asset manager contacted me (finally!) she basically reamed me out for sending it to the wrong location and not contacting her! I put a call in to forge a complaint. I'm over this despicable lack of professionalism, belittling behavior!

TODAY... I had a real estate agent show up at my door and tell me that my home was being foreclosed on? WHAT? I started crying and nearly had to call an ambulance I was in a panic attack. We did not have any papers or any warning of this!!! I dropped to my knees and cried, "What in the world?" My husband stated we were in a loan modification and all was going to be just fine! SURE. Now that I read all the lies and deceit caused by these scumbags! YOU were wrong to do this to us without any warning! This is shameful! Where is the integrity and ethical behavior... it's gone. You'll be hearing from me soon... for what you did to me and my family. Businesses like this should be SHUT DOWN! You are frauding the government with the Treasury ACT and obtaining the $5500 to say you're doing a loan modification when in FACT you are NOT! FOR SHAME! The FBI and Secret Service should be investigating this!

Wow, reading reviews from others about this company confirmed that I am not crazy. In 2008 I filed chapter 13 bankruptcy. My mortgage was not included in this but I did reaffirm my mortgage with M&T Bank (who sold me to Bayview). I've owned my condo since 2001 and have never been late on my payments. I have every copy of every check as proof as well as my bank and bill pay statements. I successfully completed my chapter 13 in Sept of 2013. In Dec of 2013 I got a bill from Bayview stating that I was a month behind and also that I owed them legal fees of $278.00. I called and told by the man who answered that he would have to transfer me as he couldn't speak with "people like you" (his exact words). The man I finally spoke with told me that I missed a payment in Aug of 2012, and that the legal fees were because when I missed the payment that they had to pay an attorney to drive by my condo and make sure I hadn't moved out. (Seriously!?!)
I sent them proof of all of my payments and everything was fine for a couple of months when again I got a bill saying I was behind. I called again and was treated poorly. This time they said I missed my April 2011 payment. Again I sent proof. I also told them that if I had missed a payment while I was in bankruptcy, that they were by law supposed to call the bankruptcy courts as well as my attorney and that they were in violation of the bankruptcy code. Since then I have been trying to deal with them. In December I even did a three way call with them and a representative from Wells Fargo Bill pay so she could verify that all payments were made and all checks cashed. The person from Bayview was so mad that she hung up on us!
Today I got a statement from Bayview stating that the payment they received on Mar 2, 2016 is in "suspense". Also twice I have sent them the HOA certificate of insurance and on the statement I received today, I was billed for insurance! I called and spoke with a woman named Maribel, who insisted I have been a month behind for 5 years now. I asked why I haven't been charged late fees and she said my original mortgage doesn't allow it (trust me, it does). She gave me a FAX number to send everything to. I'm going to but I know how it will play out.
I am sending a complaint to the state of TX Department of Savings and Mortgage Lending and I'll see if that gets me anywhere. All I know is that ever since that statement I received in Dec of 2013, I have been so stressed over this, have had countless sleepless nights and am sick of their condescending attitudes. You can count me in on any class action suits! They have got to be stopped!!!

If you read my consequence in full... thank you. I have never had the opportunity to speak with or relate to people who are involved in this mess of trying to keep a home. We are currently in the process of doing our third attempt with Bayview Loan Servicing on our mortgage that was sold to Bayview from Bank of America, while we were in a 2nd attempt with Bank of America to process the Loan Remodification when the loan was sold to Bayview. Prior to the process, we purchased a home in 2008 and went through this similarly in 2013 during the Mortgage Crisis, ultimately walking away from our primary residence during the Government "Bank Buy out" protocol that allowed Washington Federal Savings and Loan, to quickly bankrupt their bank and change the name after they participated in the bailout. They did not remodify any loans.
However, in 2008, Washington Federal quickly approved on a $600,000 loan based on our asserts. Upon acceptance of the offer, the bank would not allow us to do our own appraisal, suggesting that the home was going to be auctioned in a week and the appraisal that they had in the file would work to suffice the loan for closing. However, little did we know that the Builder who built the home had 5 homes on the same block with Washington Federal Savings and Loan, and our Realtor made certain that we were getting an awesome million dollar home, (according to the past appraisals) and that we could gain much equity in 5 years. She even mentioned that she almost purchased the home for an investment herself.
The Bank Manager Brian ** led us to believe that the payment would change in the next few months from $4200.00 a month to just over $1900, with a promise to refinance our other retreat home and use the equity to lower the payment with a new program they were offering multi-home buyers. So, we withdrew $148,000 as an early retirement and used that for the down payment. It never happened.
The housing market crisis started to push our neighbors into foreclosures on both sides of the street in a community of about 200 high end custom palaces.We waited on the approval to lower the payment, which was denied due to the amount of loan and depreciation that hit the market. The purchase was $740,000. with a $150,000 down payment at closing that we were supposed to receive $1800.00 back from the title company for overpayment of the down payment and we had to fight to get that returned to us as it was an overpayment.
Both the Title Company, Branch Manager and Bank made commissions, manipulated the numbers in the file and would make up "bank fee verbiage" to justify the confusion that they said we had at closing. We paid the Mortgage for over five years consistently while diligently trying to lower the payment with the MRC or Re-Modification after a decline in income... Not only did we NOT get to re-deposit the early retirement withdraw back into our retirement, but we're unsuccessful in getting anywhere with lowering the payment to be able to keep the home and try to build from the loss.
Moral of the story was the home was worth about $500,000 when we got the loan and the bank used an OLD APPRAISAL in the file. They stated it was almost a year old and was crossed out and written over by the appraiser to suffice the closing. We had a $600,000 mortgage with a bank that helped ruin our impeccable credit and would not allow us to lower the payment so that we could at least regain our credit to make the payments each month.
We value moral respect and we're willing to continue paying on a home loan of $600,000 knowing the reality that the home's value was about $550,000 and steadily falling in value by the month. We knew that if we would have stayed in the home for 20 years, that we could NEVER make any gains or recover the losses. The house started falling apart, the concrete on the foundation was spitting, the upper lever balcony and much of the roof was never repaired by the builder Sunrise Development - Justin and Christine ** which was all listed in the closing agreement and signed to repair.
We finally moved out in May 2013 and watched the value drop down at one time to around $489,000 on the home. It finally sold in December 2014, after we were long gone, better educated and seeking legal actions, while still licking our financial wounds. The scamming builder who lied for over 5 years was now paid to do the repairs by Washington Federal so they could put the house on the foreclosure market. There was NO Confidentiality in our case and both the builder and the realtor Carey ** from Woodhouse Group were in on the fraud and misrepresentation to us with Branch Manager Brian ** leading the way on how.
We currently moved into our second home which is a mountain retreat that we paid cash for in 2004. We had a small loan with Countrywide Mortgage, which was then sold to Bank Of America. When the previous early tax consequence and losses snowballed into a tax problem, we reached out to start a Re-Modification with Bank of America, which was in the second attempt at processing and nearing a fair resolution and we were almost to closing, when Karen the BOA loan officer that was servicing the process informed me that the loan was sold to Bayview and that someone would soon be contacting me to continue the Re-Modification.
Nope, they had nothing except the loan number and I was assigned to Toby **, who has been the servicing agent now for almost over a year... I have sent over 3 RMA's due to them taking so long and the application needed updated financials. Continuously have called, emailed and left messages. Nothing for weeks and then a letter will come requesting some type of document needed again. WTF??? Is there any resolutions known in a Re-Modification? How is this Legal? Who would be interested in petitioning a Class Action Lawsuit and advocate for people in this unsecured process of wondering if they are going to lose their home.

Our mortgage was sold from Chase to Bayview and it has been a nightmare. We live in a HOA which provides liability insurance as part of our dues. We noticed our payment increased and contacted them for an explanation and was told it was because we didn't have or provide proof of insurance so they charged us for a policy. We explained the HOA insurance and was told to submit by email or fax which we have done more than 4 times. We called again and was told it would be taken care of so we faxed. Emailed and sent proof of insurance with payment and now we are getting a foreclosure notice. This company should be shut down based on all the negative and criminal acts that have been posted for similar situations. I am turning this over to my attorney. DON'T DO BUSINESS WITH BAYVIEW. THEY ARE SCAM ARTISTS AND THIEVES!

This company is a thief! Our loan was also sold to them from B of A. I called to modify our loan as we fell upon hard times. The first time I contacted B of A, I was told a rep would call me back, when that happened, the "rep" had me pay $5000 in cash to modify... my fault for not having my guard up. In all fairness, I lost my brother to suicide in May 2014, when all this started and my mom to cancer in October 2014. Life sucked, however, I was eventually called by Roosevelt Law, who modified our mortgage, with an incorrect address. I have repeatedly tried to have this corrected, to no avail. I am now at a loss as to continue to pay my mortgage, or try someplace else...

My mortgage was sold to Bayview in October 2014. Have never ever been late on my payments. I use Bank of America online banking. In 2015 I was charged 3 late payment fees, only 1 was refunded. Was told that only one per year is allowed. A CSR at Bayview indicated that there seems to be a system error that payments received after the first gets tagged as late. Bank of America tried to have January 2016 late payment fee removed. I just tried and to no avail. My payment was not late. BOA will not deliver mortgage payments late deliberately. Bayview posting system is not accurate.

We had a loan with B of A and it was sold to Bayview after we missed a few payments. The payment started out at $1100, it is now $1500, from fees and other various monies added. Our interest rate has stayed the same and yet our loan amount is only going down maybe $75 a year! Is someone going to get a class action lawsuit against these guys or what??? I'm in! I just don't know how to start it!

Several months ago I was experiencing financial struggles and reached out to Bayview hoping to get some help. The very first thing they always tell you is that the call is being recorded for quality assurance. I asked the representative if they would offer me a postponement of payments for 2 months while I get back on track. He put me on hold for a short while and came back. As he was typing away, he said that I was all set. I clearly confirmed with him at least twice as to when the next payment would be due (in October). He said yes... at least twice! I was very pleased because it would give me time to catch up on other debt and a chance to breathe.
About a month later or so I received a call from them stating that I was 2 months past due and that I would soon enter foreclosure if I didn't make a payment. I advised them of my last communication which they conveniently didn't show notes of on my account. I was told a supervisor would review the account and call me back. 2 days later I received another call from an account manager stating that they never offer postponed payments and that they didn't have record of my conversation. I urged him to go back and review the recorded call. After a couple of conversations with this "account manager" in which I asked him to review the "recording" he claimed that he hadn't had a chance to listen to it but regardless of what was said that I would have to begin payments immediately and catch up the 2 months overdue.
This company of full of crap!! I once placed an order for a car part from a small company I found online. When I received the order I realized that I got the wrong item. I immediately called to complain about the order and advised them that I think the person sent me the wrong item. Within seconds I received an email with a recording showing how I clearly ordered as the wrong item. So if a small company can go back and quickly send me a copy of the phone call proving that I was wrong, why in the world can't Bayview do the same!! If I was wrong I'm sure they would have done the same. But because they screwed up they claimed that they didn't have time to find or listen to the call and regardless of their findings, I would still have to catch up. There's no accountability with these people. The left doesn't know what the right is doing and worst of all, they don't care! I will be shopping for another lender ASAP!

I had my mortgage sold to Bayview in 2014. Ever since that date I have paid the amount due plus extra that should be applied to the principal only. They have constantly misapplied my payments, suspended my payment into a limbo account and say I have not paid the payment. After weekly and daily phone calls to customer service I ask to fix the application of funds. Sometimes it works but 9 out of 10 months it does not get corrected properly. This misapplication makes the loan amounts wrong. When paying the principal extra payments amount the interest should be reduced. I find the interest is sometimes more the next month. To my surprise today I got a certified letter from them advising what steps I can take to avoid foreclosure when they have over $2000 in some sort of suspense account. NEVER DO BUSINESS WITH THEM.

We have been on the phone with Bayview every other day. Especially lately they are trying to tell us that we missed a payment in June of 2015 (hello we are in January). We had to send over evidence from our bank saying that we sent the payment and they cashed it. Now they are sending us emails saying that we didn't make this month’s payment. I am sorry people I have made every payment since we got the loan. It is crazy to deal with them. We keep getting transferred and keep sending stuff over via fax. And then they tell us to call back in an hour to see if the fax went through. Such a headache. I don't know where they are heading with this.

My Father fell ill to cancer, that thankfully was removed from his colon about 4 years ago. My mother is legally crippled... My husband and I took it upon ourselves with discussion between my father, my mother and ourselves to leave our home of 8 years to reside their basement to help pay the first modification they were able to get. Since then my husband and I are currently living in a "new" home, formally my late in-laws I lost last year. I had another child, had cancer removed from my cervix, and am only 37. My father's heart is now failing along with many other health issues. My mother currently needs a hip replacement, she is only 61.
My point in explaining all this is we are real people with hardships in life. My mother was a nurse's aid for 12 years and my father worked for Meridian health system for over 30 years. It took until 2016 to get him fully insured for medications needed for him to survive. He was paying out of pocket prior to now. They both live off of social security and disability. During the time I had to move with my 2 kids and 3rd one just born, my family was trying to re-modify their home. My mother isn't great with legal paperwork. She is always worried about my father passing and her bills.
She has sent this company BAYVIEW LOAN LLC that her "debt" (mortgage) was passed to. They NEVER ANSWER! I call the bank the mortgage was sold to and they get a Bayview Loan LLC person all the time. My parents have resided at their home for almost 30 years. It's not just a house. It's my childhood home, my sister and brother's memories. My twin brothers' only home they know. MY PARENTS' NEIGHBORS the most wonderful people God could have ever blessed my family with. It's so sad to me people want nothing but to take money. You're not taking money from my family by procrastinating and never answering or yet calling me back as the advocate for my father who can't talk for more than 5 minutes, because of his heart and high blood pressure. You are rude, inconsiderate, heartless, greedy people with one thing in mind... MONEY. The root of all evil.
My parents just want a place to live and have their kids and grandkids to keep coming too. A place they can be for their last days, when that time is to come, a place they worked so hard to have. A place they raised 7 children together in. To you Bayview Loan LLC it's just another house on your desk. To me it's my mother and father having a place to live out the rest of their days. A place I call HOME!!! All we want is to get started on this modification before YOU make it too late for them. They have called, written you, sent you paperwork. I've called and called. Spoke to you several times and you NEVER called me back as promised LaKisha!!!

My mortgage was sold to Bayview from BOA. I tried modifying with BOA and instead of them working with us, they just sold our mortgage loan to Bayview for pennies on the dollar. Our mortgage was a MERS transaction from Countrywide to BOA. BOA didn't foreclose because they knew legally they did not own the note. So instead of dealing with me they sold it to collections. The name Bayview Loan Servicing sounds like a legit servicer until you call and they are a debt collector trying to collect a debt. My issue with Bayview is my mortgage is 150k they most likely purchased for 50k. BOA writes it off as a charge off. How can Bayview legally ** us for over $100k. I must say they are persistent.

I was working with Bank of America on a short sale and the loan was sold to Bayview Loan Servicing. The short sale had been approved with B of A, however I needed to still have approval from another bank on the 2nd lien. While waiting on the 2nd the time frame B of A gave us expired and they would not give us an extension until we had approval on the 2nd. During this time (1 week) they sold the loan to Bayview Loan Servicing. I have been in contact with Bayview since they acquired the loan on July 15, 2015. It is now November 4, 2015 and still no approval! I have had the approval for the 2nd shortly after Bayview acquired the loan. I call and email on a regular basis and very rarely receive a reply. They did ask me to send a new HUD 1 as they will not pay seller concessions as B of A agreed to, so the buyers agreed and the new HUD 1 was sent. That was on October 19th. Not one word from them and no replies to emails or calls.
I would love to be able to write a positive review and commend Donavan ** and Matthew ** for their outstanding service but unfortunately I cannot due to broken promises and endless poor customer service. Bayview Loan Servicing only gives lip service! They come across very nice and act as though they are going to act immediately and promise to get back in contact within 2 days and they never do.

I cannot make this company understand that my husband died suddenly. I offered to send his ashes with another certified copy of his death certificate. Bayview bought the loan which was not in arrears and has subsequently harassed me that I had to leave my home. My home was for sale and they refused two very good offers to sell. This company is pushing me to the limits. The tactics are unethical, illegal.. I am 73 years old and even my attorney cannot get them to cooperate. I offered to pay something on my loan just until I could get the house sold. Bayview has not cooperated with me in the least. They bought this loan for pennies on the dollar.

My husband and I bought a house in 1999 with American General/Spring Leaf. They said our account was current and was doing good. Suddenly with no written notice told us that they no longer handle home loans and turned our loan over to another loan company. Sps sold to Bayview. They never said it was collection co. Threatened foreclosure. Need help.

I was into a loan mod with BOA when we found out at a lawyer conference that we had been transferred to Bayview. We were 1 year into the process after all the items they kept asking for were given when I was told I would be given a three month trial. 6 months in they asked about liens that my wife and I had at which we showed proof that my wife's were not hers and mine was credit card debt that we were then told they weren't concerned with (documented). Then after paying the trial for 14 months we were turned down because of the credit debt and all money paid was returned to us, and the 14 months were added to the delinquency which put us in a deeper hole. This is the most unethical company that I have ever dealt with.

My loan was sold to Bayview and the loan fell behind. I tried to work with Bayview with no cooperation. They sent me a loan modification packet and I returned the documents and it was turned down. I moved out and stop paying on the loan in 2014. It been 16 months later, never received word from Bayview for foreclosure proceedings. Bayview is aware the property has mandatory HOA dues and no HOA dues has been paid on the property since I moved out. From time to time, I see the HOA manager at the grocery store and she ask me about the property and I have nothing to report. Bayview can have the property and deal with the HOA.

My mortgage with Bank of America was sold or transferred to Bayview Loan Services. I was 3 months behind on my mortgage with BOA. Made arrangements to catch up by making 6 payments in 3 months. I was 1 day late with the 3rd payment. I was supposed to make the payment Friday before the end of the day. Unfortunately I was at the hospital with my sick wife. I made the payment at the bank first thing Saturday morning. I normally would have noticed the withdrawal from my account by Wednesday before the end of the day. This time the funds were still in my account. I waited until Friday and the funds were still in my account. I called my account manager and she said the payment was late and I am now in default. I explained to her what happened to no avail. She said I would have to order my reinstatement figures to find out what I owed, however she couldn't do that. She then transferred me to someone else.
After playing phone tag for a week I was finally able to get them ordered. It took 3 weeks to get them. I read the paperwork and found those figures expired and I would have to order them again. I was on this merry-go-round for 3 months and I was highly upset. Needless to say, I am now 6 months behind. On the sixth month I get a certified letter from an attorney advising me, they represent BOA in the foreclosure proceedings. On the seventh month I get a certified letter from BOA saying they no longer hold my mortgage, Bayview Loan Services does. A month later I get an escrow statement and a certified letter from Bayview. They offer me a loan modification. Of course I am excited and complete the package they send me and include all the necessary paperwork. After waiting 2 months I call to get the results and the account manager tells me I was denied because I sent them the wrong package. I was infuriated.
I admit I did yell. I said, "How could I have sent you the wrong package? I filled out and returned the package you sent me." The account manager (male) said, I was rude and he could no longer assist me. He then hung up. I blew my stack. I admit, if I could have broke his face I would have. To make this long story short, after applying 3 more times for a loan modification I was denied every time. Each time they said I did something or did not turn in something. Now it is over 2 years later and I am waiting to go to court for the foreclosure. I really wish this never got behind in my payments. This all started because I am a municipal government employee and fell victim to furloughs. My salary has been restored and I could pay my mortgage but I am so far behind. If there is a class action law suit, sign me up.

Bayview is not giving "Payoff Satisfaction Letter" for the loan I fully paid in 2008. I had a couple loan with Bayview. I sold my business in 2008 but they left the lien on my condo since then. Now I am trying to sell my condo and they are not giving a "Discharge of Mortgage". I have been trying to get this letter for a week. I called numerous time, talked to different departments, faxed, and emailed. It seems they don't care and nobody knows what they are doing. I have to hold selling process just because of their neglect.

In April 2015 my loan was transferred to Bayview by Bank of America. Bank of America told me that Bayview would be sending me some type of communication and welcome package, if they haven't done so already. 2 weeks went by and still nothing was sent to me. I called Bayview and I spoke with a rep named Rachel. I provided Rachel my SSN since I didn't have an account number yet. I explained to her that I needed to make a payment. Rachel stated that my SSN isn't in their system yet to give it another week or so. I called back and spoke with a rep, said my account has an assigned case manager since I was in Bankruptcy and she was gone for the day. I explained to him that I needed to make a payment, but refused. Said I can only make a payment with my case manager. This is frustrating. He sent my case manager an email and requested that she call me back.
A week goes by and still no response. I call Bayview back again, and spoke with a new rep, who again stated they can't speak with me and will relate a message to my case manager. Said the usual turnaround time is about 7 days. By this time, it's mid June and I still haven't heard a response back. I called back June 23rd, 25th, and 26th and with no response (I have my cell phone records to prove that I called if needed). Finally on June 30th, I had enough. I refused to continue to get the run around. I insisted I talk to someone right away. The rep gave me the name of my case managers, manager name. I left message for Kelly **, expressing my dissatisfaction.
About an hour after I left a message for Kelly, Tambra **, my case manager decides to finally call me back after 3 weeks. When I spoke to Tambra I again expressed my frustration and asked for Kelly to call me back. Tambra refused to transfer me. She apologized and said she can help answer any of my questions. Giving her benefit of doubt, I continued to speak with her. She was very helpful in gathering the information needed and even returned my call with the answers she wasn't too sure of. She then explained to me, that we may be eligible for a loan modification. She sent me the packet a few days later. On June 30th, I read over the requirements for the loan mod and seen that Bayview requested mortgage statements. I don't get statements, so I called Tambra to get a copy. I left her a message. I left another message on July 3rd.
On July 6th, I decided to call and email Tambra. At this point, I just emailed and faxed in the required documents needed to proceed with the loan Modification since, again no response. On July 7th, I called Bayview and spoke with a Tim **, I explained to him that I was frustrated and unsure why Bayview treats their customers with little respect. He seemed surprised and said nothing was uploaded, but it could take 48 hours to show. Since I expressed my dissatisfaction with Bayview, he requested that I email him the loan documents and he will ensure they get loaded to my file and will CC Tambra **, Kelly ** and her manager. Unfortunately he wasn't able to give me the name due to policy. At this point, I'm not surprised. I figured since he was sending the email, someone in upper management would give me a call back as requested. Again, no response.
I've called Tambra and left her numerous voicemails with no response. I even emailed her with a delivery confirmation so I know she received my message. Today is July 21st, and at 1:41 pm PST Tambra called me. I expressed to Tambra that I've calling and emailing her and haven't heard anything back. Tambra said I've never left a message and she's been trying to get a hold of me and that I was rude. I requested to speak with her manager. Tambra said she is busy and will have her call me back. This is the 3rd time I've requested to speak with someone in upper management with no response. I would like to speak to someone in regards to my account.

My loan was transferred to Bayview by the FDIC from a local bank that went belly up. After Bayview received this loan, they had me enter into a 30-year Modification. I said OK, being they were taking the original loan and paying all property taxes and homeowners insurance for the next 30 years. Well lo and behold, they not only had me fill out the loan modification and send them $1500.00 by wire transfer and send monthly installments of $203.00 dollars (but I never received the Modification even after paying the monthly installments from August to December), but I find out they sold my loan to 2 different companies!!! Can you say fraud, and theft? I will gladly join any class action suit against Bayview if notified!!!

My loan was sold to Bayview loan services in February of 2014 and it took almost one year as my loan with American Servicing Co had started a loan mod and then sold the loan. The rep originally handling the paperwork was Juan **... he would never answer my calls. When I sent paperwork it never seem to get there on time even via email... they delayed it. I had to call and make a payment with my rep according to him... he never answered. When he called me I was always in my car driving home... did not have my check book. I would ask him to call at specific times and he never did. Then I got another rep and the cycle begins again. Finally the modification is done and signed although not totally happy. They extended the term to 36 years which I thought was ludicrous. I had been here 10 years and to have to pay another 36 years was ridiculous. Then I began getting statements of payments due which was in correct.
Dealing with this company is very stressful and illegal practices. I also had a bad experience with American Servicing Co where I began getting checks in the mail from Wells Fargo with absolutely no information on them... no perforated stub attached explaining.. no number to call. This went on for 3 months and then I got calls from law firm and foreclosure papers in the mail. I was baffled but then I realized the checks were the same amount as my mortgage. They made it seem as though I never made a payment and was 90 days late by sending my money back. I was now at the mercy of this company as no one else would touch me.. well lo and behold Wells Fargo had a class action suit against them. So yes BAYVIEW LOAN SERVICES needs a class action law suit... and to be shut down... count me in.

I had my loan transferred to them by M&T bank. M&T bank purchased our loan form Chase. After many months of working out our new loan, we signed our new documents in February. We told numerous times that our first or next payment would be due once the loan was closed. Bayview took 3 months to process our documents and in May we received an aggressive call from a Bayview employee (someone new to our account) saying we were in default on our loan and that we owed them over $7K. It was obvious that there was something strange going on because we followed Bayview's process all the way until closing.
Now they want to add the $7K plus to our new loan? This is a scam but I don't know what rights I have. Bayview claims I am in default of a loan that never closed. How is it that M&T or reputable banks work put their reputation on the line by working with a company like this? There is no question in my mind that we are being bullied and scammed.

I was hired by Bayview in October 2012 as a Foreclosure Coordinator. Part of my job was to run SCRA Searches on a Government Website known as the Department of Defense Website. In order to Proceed with the Foreclosure you have to check if the Borrower(s) are in the Military on this Website. If the Borrower is in the Military you cannot proceed with the Foreclosure. The way you have to check to see if the borrower is in the Military you need the Borrower's Name and Social Security Number or you could use a birth date but that is not an accurate search.
February 19, 2015 The Foreclosure Manager directed myself and two others by E-Mail that if we cannot locate a Social Security Number then to use an Invalid Fraudulent Social Security number of 999-99-9999. That is complete Fraud and an abuse of the Government Website with a Fraudulent Social Security Number. I refused to do so.

I needed help with my mortgage after going through a sudden illness that left me unable to work. I actually was close to retirement age - I was 62 years at the time. I spoke with CSR at B of A. They took my application for modification and told me that someone would be in touch. I kid you not when I tell this took from Aug of 2009 until July of 2014. B of A gave me the run around for 5 years and during this time I was getting further and further behind. Anyway eventually they sold my loan to Bayview Loan Servicing. After checking the people in charge of my loan never turned in any modification papers on my behalf because no one was ever handling my case. My case got shifted from place to place and finally B of A sold my loan which was the best thing that could of happen to me.
A young man by the of ** took the time to help me go through the steps. I didn't have any faith in him - I had said to myself he is going to do the same as B of A. Not true. He was sincere. He helped get all my documents together and made sure that I had all papers before I sent them in. Within 2 months everything was taken care of and I now have a mortgage that I can afford on my fixed income, hopefully Bayview will hire more employees like Mr. ** and turn a POSITIVE CORNER and that will be good for all.

We have completed 3 loan modifications with Bayview Loan Servicing and in each case they have adjusted the agreed upon pmt. to an amount higher than the original pmt. amount within 30 days of completing the modification. The last modification was completed in March 2014 with the first payment due in April 2014. We made the April 2014 pmt only to receive notice from them April 12, 2014, that there was a "miscalculation" in the modification. They increased the monthly payment by more than $1000. In July 2014 we sent Bayview a certified 10-page letter detailing all of the concerns we had with the servicing of our loan. They responded by sending me a copy of the letter we sent to them?
In April 2015 we were contacted by Rubin Lublin LLC, (their attorneys) informing us Bayview listed our property for sale June 2, 2015. We immediately send their attorneys a certified copy of the July 2014 letter as well as another copy to Bayview Loan Servicing. On May 15, 2015 Bayview responded in writing stating that they would be addressing all of our concerns noted in our July 2014 letter. However, they have listed our property for sale as on June 2, 2015. On May 19, 2015 we sent another certified letter to both Bayview Loan Servicing and Rubin Lublin LLC requesting that they NOT sell the property AND that Bayview honor their words and properly and thoroughly address our concerns associated with our loan.
** has been assigned to handle our loan but each conversation with him consist of him being rude, unprofessional, loud, disrespectful or him hanging up on us. As of June 2, 2015, ** response to us when we contacted Bayview for a status update was "We're not going to do anything. If you want to contact an attorney, be my guest but we are foreclosing." When asked what about the May 15, 2015 Bayview Loans sent to us claiming they would be addressing our concerns raised in our July 2014 letter he replied. "Whatever, disregard it," I asked to be transferred to his supervisor and once again he hung up on us. We have conveyed our desire to retain this property but Bayview is refusing to honestly and fairly address the repeated mis-management and servicing of our commercial loan.

After 4 hours and several calls finally got a rep ** who ended up hanging up on me. Ins. Policy and payment sent to their Asset Dept in April 2015, again on 5/8/2015, yet ** claims nothing on file. They allowed the ins to lapse on 5/24 and are taking no steps to re-instate it. Buyer beware this is how "they help homeowners through modifications."

I was hired by Bayview Loan to sell a REO home in Virginia. The Asset manager refuses to pay for all the money I put out for the care of this home - electric, gas, plumbing (the pipes broke). I had a buyer, they canceled the contract after the winter. The buyer they rejected listed they now are in negotiation with. They blocked my request for being paid. I should get the paid plus my 3000 dollars. But worst is the treatment is criminal.

I had set up auto drafts from my checking account to pay my loan. They take the money in a very inconsistent way so I decided to cancel the auto draft back on February. I called in March to verify it had stopped so I could make the payment and they informed me I had been stopped and I made the payment myself. Later in April I sent my payment and for some reason the auto draft kicked back in and they debited my checking account creating a duplicate payment. I called and they wired the money back to my checking acc. and ask me to email and fax another request to stop the auto draft which I did but... in May it happened AGAIN.
I called and after 10 days they have not refunded the extra money they took (they did refunded the NSF charges I had in my account due to the extra payment) but the payment amount nothing so far. I sent another email to the Customer Relations Manager and now my emails are rejected. Stressful experience dealing with people that has no clue how to handle loans.

My loan was transferred to Bayview. From day one they have given wrong information. One representative tells me one thing and the next day I get different information from another. They are apologetic and tell me that the other rep was wrong by giving me that info. I had ask to speak to a supervisor, they transferred my call only to be put on hold for over 20min. and be disconnected. They never intended to let me speak to a supervisor. I think their own supervisors are avoiding customers calls. This is one of the worst companies I have ever dealt with.

My short arm was transferred to Bayview almost two years ago and they are horribly incompetent. They, without my permission, appear to have converted my loan to an interest only loan and refuse to correct it. Each month, when I get a statement for the interest, I pay the normal amount and designate the overage to go into the principal, and each month they apply the overage to the next several months of interest. I am so tired of calling them to correct this issue. This error is noted in my file several times and they still cannot get it right. At one point, a customer service rep explained to me that the people that process the payments are just doing 10-key and don't look at the slips that come in with the checks so I should just keep calling. Excuse me?? Ridiculous.

They never return calls and your rep is changed constantly or no longer there. They do not tell you anything straight up and then you find out you owe a ton of money. They are not even friendly to talk to and always claim they never received anything you sent them. Then your mortgage goes back up. I am so frustrated and hurt by all the problems. Still have not seen all the figures and am scared to know. They are not professional and blame everything on you and are even rude. The details are told until it is too late.

BofA held our loan but when we needed help with the payments for 3 months when I first became disabled. BofA started a year long paperwork merry-go-round with us eventually selling our loan to Bayview Loan. Everything started to come up roses and was going great with our refi then they too sold out loan to Rushmore Loan months ago. Tax proper or was going through all the paperwork I brought in and noticed that with our mortgage interest paid notice was a 1099-C that says they charged off $25k in bad debt against us! We never defaulted on the loan and we paid them everything we were supposed to so I call them. Every option to press says it's transferring me to a customer service rep then hangs up on me! Can't even get to a human being to find out wth this is all about but it could cost us $8K in taxes we'd pay out for this lie!

My loan got transferred to Bayview in the middle of March. I call that day it got switched, they say I'm not in the system yet and to call back in 10 days... what!? So I wait a week and make the rest of my Feb payment to them. It's still sitting in my account applied to Feb. I keep getting letters and calls saying I owe them all of Feb which isn't true. I have proof I paid the rest to my previous loan company. Did what Bayview said, faxed them a letter from my previous servicer stating I did indeed pay. Now where it went when the loan got transferred, I have no clue. I call almost every day to get this resolved and nobody seems to know how to help me. I'm not sure what more I can do on my end. I have my previous loan co. looking into too. I'm just so confused on how a loan can get transferred but nothing else can. This company is terrible to deal with.

I have been requesting an appraisal for almost a year now (I want to see if I can stop paying for PMI) and I finally got them to find at least one of the 5 or 6 requests I sent. The appraisal was done January 15th and now it is April 8th 2015 and finally got an answer from them. They are telling me that I have to wait until 2038 in order to request for the PMI to be taken off, obviously they are not even looking at the fact that they have an appraisal on somebody's desk taking up space and collecting dust. Their customer service is the worst!!! If my interest rate wasn't so low I would change lender in a minute. If you are going to deal with Bayview Loans make sure that every time you need to make a request or ask any questions, you have much patience because it is difficult to deal with Bayview Loans. My husband had a mortgage with Baco Popular then Chase bought the mortgage and now Bayview is the servicing company. I am not on the mortgage or on the deed or hold any mortgage with any bank, as a matter of fact, I am in bankruptcy. My husband needed a modification and he authorized me as his agent to speak on his behalf when he was submitting all the paperwork needed. Almost two months ago I got a 1099-c miscellaneous tax form, so when I tried to filed my income tax, my accountant explained that Bayview had reported to the IRS that they had forgiven me about 5K, that is why I was getting this tax form and as a result, my tax return is about half of what I usually receive, but my accountant asked me to get this issue resolved before filing, otherwise I will have problems with the IRS.
I have contacted Bayview many times, I have faxed the request to have this information corrected with the IRS and in one particular time, I was speaking with **, a customer service rep, and I asked to speak to a supervisor and he just kept asking, "For what? They are going to tell you the same thing, I just told you that they are working on it." I am so furious that they would take my name and report this false information, and why should I have to wait to get this issue resolved when I AM NOT A CUSTOMER OF BAYVIEW LOAN SERVICING, LLC. I would love to file a lawsuit against these **.

My husband and I are both on SS and are disabled. We have been mailing our payments in a couple of days before the due date because our checks are deposited automatically. We have some that were not received by the due date but it is my understanding that there is a grace period. In DEC we were notified that the original mortgagee, CitiMortgage was taking the mortgage back. Now we have both of them sending us letters saying we are behind one payment of which I disagree. I have duplicates of each payment in our checkbook. Sadly all the reviews I read are all about the same practices we have encountered. We live in a 20 yr old double-wide and trying to do the right thing. My husband and I are senior citizens. Apparently these people don't know what's up with their business especially in the area of how to treat others. They are also charging with a late payment fee of which we disagree with. I received a letter from Bayview in Feb 2014 saying to contact **. I am to call immediately to discuss options that may be available, and the longer I wait, the further I will fall behind in payments. I am current on all my payments. So I called, never got to talk to a human. Left voicemail messages and never received a return phone call to explain. Then in March I received my bill saying I owed my normal amount due April 1st. So I figured maybe they found their mistake... then I just received another letter stating all the same nonsense as I stated earlier, only this time to contact someone else, not ** before I fall further behind. As far as I'm concerned, this is harassment. I will gladly join a class action lawsuit against this company.

They are incompetent, their online loan payment system is flawed, they don't know the answers to very basic questions. I have paid online for the two years. I've had the misfortune to be with them, and now suddenly they are not able to process my routing number, and no one at customer service seems to have a clue. I asked how to go paperless, since I can't find that on the website, and no one knew. They are a time waste. Bayview must provide its employees with training, and probably pay them better as well, so that they can provide services. We do not have a right to choose who has our loans. If we did, Bayview would go out of business.

My loan got transferred from Wells Fargo on December 2014. I have only experience incompetence since. This has to be the WORST company to deal with! How are they still in business. My auto pay is setup for the 15th of every month and yet I get multiple late notices and no one ever picks up the phone when I try to reach someone. Once you do reach someone it's yet another headache! I am just stumped as to how these people stay in business.. I am so going to look to refinance just to get away!!!!

My mortgage was with Bank of America and was transferred to Bayview in 2014. I needed a loan modification due to income reduction. This past December, I faxed the paperwork as well as sending it by FedEx and I called and was informed that it had been received and the under writers were working on it and the lawyers had gotten me a postponement of 75 days for the auction that had been scheduled for December 29th. I haven't heard anything since Dec 23.
I called to speak with David ** who had been working with me since March and to my surprise the customer service agents acted like he was not there and couldn't find him and didn't know anything about my modification. I asked who was having my case, they asked my loan number and transferred me to a rude guy named Marvin ** and he refused to say anything the paperwork I submitted for the modification and abruptly stated that my house had been sold in the auction on Dec 29, to Bayview and I need to move out by the end of this month Feb 28.
He said they would offer relocation help of $1000 and I have to sign something called cash for keys and a W9. I asked why no one had contacted me, he had no explanation for anything. I feel I have been scammed. I called today a number I found on paperwork that David had sent me and was told by customer service that he no longer worked for the company. I too am willing to join a Class Action Suit against Bayview Loan Servicing.

I concur with Craig from Brooklyn NY. I have paid my loan through auto-pay ALWAYS. I have not missed a payment. Citimortgage, who caused me an unbelievable amount of grief after Hurricane Ike by not paying my windstorm, turned my perfectly paid mortgage over to Bayview. They know nothing. I get duplicate communications in e-mail, mail, and FEDEX'd. The transition of my loan has been horrendous. I was auto-paying on the 8th of the month to Citi. Baview has the 5th or the 10th or the 15th. I picked the 10th. They send me e-mails saying my payment is with 2 escrow payments; they send me e-mails saying my loan payment is due 2/1, WITHOUT saying that I am really auto-paying on the 10th. This prompts phone calls WHILE I AM WORKING.
They are worthless. When I asked Albert ** (spelling may be wrong) where I can file a complaint, he had to ask. After about 5 minutes on hold, he comes back and starts explaining something to me that I did not ask. I verified his name and said "So you are refusing to give me an address I can complain to?" to which he responded that he could not find where to complain to. This company is a nightmare and a joke, and they haven't even taken a payment yet. I am not stopping until I get resolution on this. I am so concerned about their incompetence.

In March 2014 my loan was transferred to bayview from Franklin credit. In 2010 I filed chapter 13 because my husband was laid off for a year. Since then things have been going ok. Well in 2014 when my loan was transferred, the nightmare has begun. Well I got injured at work and was on disability and was told I could do a modification because our income had dropped, since I'm the bread winner. They sent me the papers, I completed them and mailed them back.
Upon doing so my assets manager called to tell me I needed flood insurance, because I was now In a flood zone... Ok had to get a surveyor out $450 to complete the process and I called them because they have been calling telling me I needed flood insurance ASAP. So when I got the information from the surveyor I called Bayview to let them know that I would have flood insurance in 2 days. When I called they told me after corresponding with them, sent them the information for the modification that I had never call them for modification then never received paperwork from me and that I would have to start the process all over again.
I talked to at least 5 people on the phone, no one can find any information stating that I had called them and that called me. I was told that every time you called it was put into notes but my notes have disappeared but the lady in ensured that this phone call was being put into notes. So I asked her "am I going to have to record you, recording me, recording you?" She got upset and hung up on me. I called back and in explaining my situation to another person he told me to resend the documents and he'd fix the problem. I didn't told him that I was filing a complaint with the BBB. But keep telling me he'd fix the problem. But upon calling them yesterday, they don't even know who I am, and have transferred everything over to my husband's name, and can't to anyone but him!!! Urgh the company is a sham and needs to be shut down and a class action done.

I had my loan with Bank of America. Without my knowledge they dumped me to Bayview, whom I have never heard of. For two months they harassed me and told me that I don't have an insurance for my condo. Condo's insurance are taken care of by HOA. Bank of America never gave them that info so I had to do all the work and find out the insurance company and give them the info. Now when I called them to make sure everything was ok, they told me that my payments have increased from $1231 to $1700 and in March it will be $1900. They also told me that my interest rate went from 2.3% to 5.3% in just few months that they took over the loan?? I can't even sleep. I'm so frustrated and stressed.
I'm newly married and about to be a father soon, these sharks do not care about how people live or die. When is our government going to help the people of this country?? When is fair going to be fair? Anyone have any suggestions?

Originally, my mortgage was with Bank of America. I was never late on a payment. When changing bank accounts, BOA kept messing up with withdrawing the mortgage payments. Because of this, I was 1 month behind and they sold my loan to Bayview. My payment was $1,225 with BOA and $450 for taxes. Now paying Bayview $1,769 which included escrow for taxes and insurance. I started a HAMP with them. Turns out at the end of it all, I would save $50 a month on my mortgage but would have to pay a $20,000 balloon payment at the end, so I did not complete the process. A new surprise, I get a letter saying, "Please pay $57,281.94 by 1/1/15" and I'm 441 days delinquent on my mortgage. I see that I'm not the only person that's having problems with them. THEY A NEED CLASS ACTION LAWSUIT AGAINST THEM ASAP ALONG WITH A SHUTDOWN OF THEIR BUSINESS.

My father passed away in 2010. Chase Bank was informed of his demise. The La Pinata Condo Association put the condo into foreclosure years before I started getting nuisance calls from Chase Bank. Every time they called my cell phone and asked for my father, I would inform them that he has passed away. They would apologize, hang up, call back days later. Then Bayview loan Servicing started phoning me constantly, when I tried to explain all the circumstances, I was told that I could not be given answers to my numerous questions because I was not legally involved in the matter. If that was the case why have they continued to harass me, up until and including today.

FIRST: Bayview sent me a letter that I could refinance "guaranteed." Went through the process and was denied. Paid $500 to a crappy inspector who valued my home SIGNIFICANTLY lower than the market value. Husband got into a motorcycle accident w/ 18 wheeler; we fell behind 2 mos... After paying the mortgage for 7 years with no issue they offer a Loan Modification to "help". I am new to this process and it was NOT explained to me properly. Needless to say I am still 3mos behind. I had $458 in unapplied funds. M&T Bank claims they didn't touch it and Bayview Loan Servicing claims they didn't touch it. IT'S GONE!!! DO NOT USE M&T OR BAYVIEW - they lie and blame each other for mistakes. NOTHING GETS RESOLVED. I did my trial payments and now my file is still in "lost mitigation".

Citimortgage (whom I have had no issues with for 7 years) sold my loan and Bayview began servicing it and turned everything into a big mess. They unnecessarily opened an escrow account and raised my monthly mortgage payments over $300. I have always paid my own home owner's insurance and taxes, but they force placed HOI anyway. I faxed them documentation showing proof that I pay my own taxes/HOI and it took over 6 months for them to investigate and remove said force placed HOI. Then they kept sending me letters saying I was past due and owed 2 months of back mortgage payments. This was preposterous because I have autopay setup and they have been cashing my checks every month for a year! I once again had to fax my Asset Manager proof of my bank statements, showing that every month for the past year my payments were received and cashed by Bayview.
Once again they opened an investigation and they confirmed I never missed the payment. But they still didn't know why according to their records I was 2 months behind! I had to keep calling them each week and after 6 months and talking to 3 or 4 new Asset Managers (explaining my whole story to each of them from scratch), they finally realized that issue was the force placed HOI. They were double charging me for insurance I never needed, even after faxing them proof that I had my own HOI. During this whole nightmare, even though I called in every week and was disputing all their claims, they kept reporting me to the Credit Bureaus. They destroyed my credit because of a problem that they created!
Bayview is not a legitimate mortgage servicing company. They are not here to help you service your mortgage. The Asset Managers don't know anything about the mortgage business and have poor customer service skills. Their mission is to con you into a situation where if enough time passes without resolutions, you could potentially lose your home. I never did anything that would warrant harassing letters threatening foreclosure. I would gladly join a class action lawsuit.

My account was sold to Bayview Feb. 2014. I did everything they asked, they even told me they would help me with an HOA issue I was having. I got the "modification" & have been paying consistently & on time - problem is M&T Bank has no information regarding my "modification" and has reported me to the credit bureau, bring my score down drastically. I've been calling all the numbers I have for the past month now, leaving messages when their voicemail wasn't full - including the so-called team leader & as of 10 minutes ago still leaving messages with no return phone call. Did someone mention a class action suit - count me in!!!!!!!!

Bayview Loan Servicing are professional pirates. At their will Bayview will increase your monthly mortgage payment ...unlawfully.....to rob you of your home or force you into a modification. They are professional banking crooks who feed off the elderly and veterans. Whomever regulates Bayview Loan Servicing should remove and investigate their records with a fine tooth comb. I'm A Tenant of Foreclosure Act in Austell Ga. The fraud has been shown to my Legal aid attorney as follows. The foreclosure was not explained by landlord. The Landlord wanted tenant to lie and say not a tenant for refinancing purposes. The tenant found this out August after a notice was delivered by posting on door and several of the same type followed by mail. The landlord wanted me evicted for alleged non payment exactly on date move. Eviction was threatened and the tenant was served. Appearance in Court was with Ga Legal Aid Society Albany Ga.
My mother, a paralegal whom has not done any such work since late 80s, begin her search. The Landlord then said "go so she can do a walk through with the bank or lender and do a DEED IN LIEU so they can get the money and credit terms that keep her credit from faltering." The Attorney for Bayview Loan Servicing LLC would be informative as general question would apply. The next thing they said the loan was not in foreclosure and could not say anything else. What happened in a nut shell? The Tenant is now in foreclosure solutions and if she can evict the tenant she will receive the incentives for doing so. Bayview would then need not to deal with the laws of the PTFA and all is done. The papers brought to Magistrate Court were just Loan Modification terms and did not show any pertinent information. The same Bayview said to discontinue payments to the landlord but it indicated that there was not a tenant but her son's girlfriend who was house-sitting.
The new info put that bait into play. They say they will move back into the condo. The Landlord is in SC and has a whole new life, had filed fraudulent eviction papers and wanted Tenant to lie if anyone asked. The tenant was suspicious and her mother told her NOT TO and was on her way. The tenant if this was true would be happy, the family IS TRYING but it's a lie. Countrywide Loans were not the best and had fraud done with him now. They hauled but???!!!??? The facts are clearer in front of the lawsuit. There's more but I don't trust anyone right now. Please call **. I have more details and they are letting the foreclosure be made not to be either.
FACT: Landlord has Separated from property for two years and tenant was harassed and tormented. The tenant's peaceful privacy has been violated in all ways. Bayview allowed the tenant to evict by taking the property off courthouse sales, requested to file that eviction. I want you out too. I am not that timid and I have been forced by Legal aid attorney and landlord to move without going before the new owners for a process. Tenant's mother wanted to purchase but they are claiming Deed in Lieu and Bayview is letting.

My mom who is 87 years old is being harassed by Bayview loan servicing. They bought her loan from Franklin credit almost a year ago. They are saying that she is like 6 months behind in her payments but she is not and she has money order receipts to prove it. We faxed them copies of the receipts and they kept sending her foreclosure notices. So we hired a lawyer and the foreclosure notices stopped until today when she received one. They keep applying her monthly payments to the amount they say she is behind so therefore her statement is showing that she stays 6 months behind and they apply late charges to it on top of that. So we are so disgusted with this. I don't know what else to do except catch a plane, go to them with all her paperwork in hand, take it and personally deliver it to them and tell them I'm not leaving until this is settled. Any suggestions from someone who has got burned by them?

I had the misfortune of having my mortgage transferred to this nightmare called Bayview Loan Servicing. The loan has been transferred at least 6 times within a year. All of these loan servicing companies lack customer service, but Bayview is the worst of all. They called me to collect when they already had cashed my payment, they increased the monthly payment as they please, they do not answer to letters asking them why they increased the monthly payment. It is really frustrating because there is no authority regulating these loans servicing companies. And we the consumers are always at a loss with the banks and such loan servicing companies.

I got sold to Bayview Loan Servicing LLC 10 years ago, got my balance down to 24,000 getting laid off and a forbearance they called it. I now owe 50,000. I've never gotten a statement at the end of my forbearance. I called and ask the lady when was my last payment before I could go back to regular payments, she could not tell me for sure. I told her I had cancer and doing chemo and did not know if I missed a payment... Next situation I decided to just pay what I thought was correct amount. I keep getting notices, say that I was not paying my payments.
SO, I call again. The kid on the phone said "I don't know why they are harassing you, you have not missed a payment in over a year," so I go back to paying my bills. I continue getting notices, so I call and take to clueless Jarred **, he don't want to talk, he's either too busy or on the other line. He says, "Call me back, just keep trying even if it takes 20 times," like nobody else has a job. All's Jarred wants to do is a home modification, I want to know where my 6,000 dollars went or was going. So I try to get a new representative to my case, no luck, so I go back to Jarred and tell him to do modification, and then we will figure out where my money went, have he has me jump through hoops for a few months, I ask him where I can send money safely, not a good response there, so now he tells me they can't help me. So I should sell the house for them for 60,000... The house is not worth 30,000. My only resolution that I can figure out is to walk away, let them have it, feed up!!!

I had a fire damage claim and have spent countless hours trying to get Bayview to release the funds for the repair work. It has been over 8 weeks now and State Farm was reputable and paid them immediately. This company has really poor business practices and their customer service is non-existent. I had asked a property manager to help me get the repairs to my home handled and gave her power of attorney with Bayview and she indicates that in 30 years of doing this type of work, she has never seen a company so hard to deal with. I STRONGLY ADVISE THAT YOU AVOID THIS FIRM AND REPORT THEM TO THE REGULATORY AUTHORITIES.

I started with BOA in 2011, my loan was transferred to Bayview. I've had too many reps to count. My story is the same as the many other complaints I have seen. It's now 2014. Class Action Lawsuit is long overdue!!!

I have currently encountered a problem with Bayview Loan Servicing, LLC. I started an automatic withdrawal from my bank account to start on the 15th of every month. Bayview decides to take it out on the 12th which caused my account to be overdrawn. I requested a letter stating it was their error so the bank would not charge me overdraft fees. They told me I would need to fax over a letter to customer support requesting this document. Unfortunately, I have yet to receive the letter from Bayview Loan Servicing, LLC. However, they did inform me that I have a $39.00 late fee according to my contract due to this error. I truly wish they would sell my mortgage to someone else.

Same experience as so many of you. BayView is an entity unto itself and very flagrantly disregards the rules of HAMP. They play games when I call; goes to rep's VM, or cuts off before. Can't get to customer service as the call is on default and goes to VM again. It's a horror story! I was told verbally that I was denied. The worse part was that they used the modification as a tool to collect ESCROW from me for this year and next year. Meaning, I will pay to them thousands of dollars which they will keep in escrow and gain humongous interest.
I asked before the property taxes and homeowners fell due to allow me to continue paying both as I have done in the past. BayView ignored my request and went ahead and paid same unknown to me. BayV has placed all payments for my mortgage in a suspense account and will only apply the payments I make to both escrow and mortgage. Which means I'm always in arrears. A $500 mortgage payment has now mushroomed to $1,300 per month.
It's a waste of time writing to them about their reps. They ignore my comments and keep plastering my account with late fees, when in reality I'm not late, paying my mortgage but they refuse to apply it to the mortgage balance only and until they've collected the $1,300. I just received a statement which states I'm past due for $2,400+. I don't understand their calculations and I feel helpless. They are ruining my credit. I'll try to call HUD tomorrow to see if I can get some answers. In the meantime, I guess we all will just have to let them do as they see fit. What a situation to find ourselves locked into!

Just found out today Bayview sold my house. Found out by attorney sending me a letter. Gave them $10,000 to refinance. They will not return my calls after some fifty times I left the messages. This being since last October 2013!! This appears to be a "Shell Game" they are playing. I do not know what to do and appears to be no help anywhere. Does anyone have a suggestion for me! So angry!

I am beyond frustration with the management of Bayview and their "asset management team"! I have given every stitch of paperwork that has been asked of me at least 20 times. I have been assigned 8 different people over the last two years.... sometimes being yanked from them in the middle of the modification process... without a call or email explaining why and sometimes with intervals of several months. The most recent.... today!!! I received a voicemail and called my new asset manager today with news again that I have been denied. It is luck of the draw if your file lands on someone's desk that is educated, professional and courteous.... not to mention empathetic to your frustration and situation. So in this round, I have found myself here again.
As I mentioned, I have been applying for modification for over two years now. I have been in my home for 22 years without one late payment. I lost my job in 2010 and was able to use my savings to carry me through for 2 years. When I ultimately fell behind 3 months they would not accept payment. I regained employment in June of 2013. The circumstances have changed (it's been two years) and I am able to pay but they won't allow the modification to go through! I have a stack of paperwork over two feet high from correspondence with them. Does anyone have advice?

I am writing to you because for 5 months I have been "fighting" with Bayview Loan Servicing about paying my mortgage. In October 2013, I asked Mayle ** if I could get a 1 month extension on my mortgage. She said Bayview doesn't do that. I asked if I could refinance my home for a lower payment, she informed me Bayview does not refinance but could modify it for a lower interest rate. At that point, I was not having issues nor had I had issues with my mortgage, although money was starting to get tight and with the holidays around the corner, it was only going to get worse. I had repeatedly heard that if you contact your mortgage company for help, its better than going past due. So I did. And I regret the few minutes Mayle ** spent with me not helping me and seemingly devising a plan to make my life miserable.
I felt I deserved a lower than 9.25% interest rate for my consistent on-time, in full payments for more than 8 years and lower monthly payments would help in the coming holiday months. In addition, the previous year was not so very good to me. I had $18000 (THOUSAND) in home repairs (not improvements, REPAIRS needed for safely and healthily living in my home), a drastic more than $1000 a month pay cut due a change in my company's pay plans (I have been there for more than 10 years!), car repairs and due to the financial hardships, my credit card debt escalated. This is life, no one's fault, just the luck of the draw all in a short period of time.
However, these circumstance all fell under the reasons to modify on the hardship application that Mayle ** said I had to fill out if I wanted a lower interest rate. She failed to get back to me and I, the unknowing consumer, assumed I qualified since I had 4 OF THE 6 boxes marked for reasons to request a modification. I continuously called for a status update only to leave unreturned messages. Finally, after my payment was past due, Mayle answered and very dispassionately said, "You don't qualify." Nothing else. No, "I'm sorry, Mrs. **, I haven't gotten back to you (She explained this away with "I was busy" when I asked her why she didn't call me back)." I didn't get a concerned-about-my-situation asset manager that said, "I tried to help you and I was unable to make it work. I wish I could have done more but your income disqualified you for any type of review."
Instead I got, in answer to my question, "You make too much money." Nothing else. I tried to ask questions about the procedure but she only answered in very short, monotone scripted few word answers "you make too much money." My biggest concern was why my application wouldn't even be looked at because of my income. The outgoing income far exceeded my incoming income because of the hardships so I felt my reasons should be reviewed based on that, not one item on the whole several page application. If that was the case, there should have been one question on the form: "How much do you make?" I paid October's payment on the last day of October (which was November's mortgage payment).
Moving on with this saga, it was now November. I found out my mortgage was escrowed. Mayle said it was standard when a mortgage got modified. I reminded her mine did not get modified. She said it is automatically escrowed when I apply. I told her she never told me that or I would have given her the info to prove I pay my own separately. She said it was in my paperwork. I reviewed my paperwork, it was not there. I later asked her to tell me where it was and told her I read everything and it was not in my paperwork. Her response: "Well, its standard." She could not or would not tell me where I had signed agreeing to this.
At Mayle's request, I submitted proof that I paid and was current on both my taxes and insurance. She also requested I fax a letter requesting no escrow on my mortgage. I did. I have no money to pay November's mortgage though since I used November's money to pay October's mortgage. And my escrow situation was not fixed. I chased Mayle down several times via phone and got no reply. After a few weeks, Mayle finally answered and said she was out sick. No one could help me because she was my asset manager. I asked her why she doesn't call me back and why I have to repeatedly call her just to stay on top, to make sure I have done what I need to do and things are getting taken care of. Her response "I am busy." At this time, she said she couldn't find the proof and letter I faxed in and requested I do it again. So I did. I have not made my November yet because I was waiting on Mayle to call me back about getting it fixed. But money is tight anyway due to the time of year and me already struggling from initially in October when all I wanted was a month extension.
Moving to December (which by the way netted another $1000 car repair so I could get back and forth to work), Mayle still had not corrected my mortgage. In December, my mortgage was still escrowed. I found out because my insurance company called me and said it was cancelled by my mortgage company. Here I go again. I chased Mayle down again and she said I had to get the refund check from the insurance company and mail it to them. Once I did that, they could unescrow my account but they couldn't until I paid them back for their own mistake that they refused to fix themselves and because BAYVIEW paid my insurance without my authorization. This was not easy, I had to spend so much time these past few months being a gopher for Mayle who constantly requested I fax this, get that, mail that, fill out this etc.
I began to feel that Bayview is one of those mortgage companies that deliberately make your life miserable so you will give up since human nature is to take the path of least resistance. Finally Mayle suggested I get put on a repayment plan for the 1 month I needed to make up. (Why didn't she suggest this when I asked for a 1 month extension instead of a modification?). I agreed after Mayle said I could pay it all off when I got my taxes but first I had to pay. I paid $500 on 12-12-13, another $500 on 12-23-13 which apparently was still escrowed and I do not know how my money was applied to my mortgage.
On 1-3-14, $554 was applied to my account. It was the check from my insurance company that I was able to get refunded to me. This also caused further issues with my automatic EFT that paid my homeowners insurance. I don't know where this money is going, I am paying what Mayle said I had to. On 1-22-14, I paid my standard mortgage payment of $920.74. I called Mayle again, I was still escrowed. She said I had to fax in a request to get unescrowed and provide proof. I reminded her I have done that several times for her. She said I had to do it again and it had to go under review. I did. AGAIN.
Now its February. I received a statement that said I was due 2-1-14 (Mayle said my due date changed due to the modification even though I didn't get a modification and my due date was now the 24th of each month). The statement also said if I did not pay by MARCH 16, 2014 it would incur a late fee. DUE 2-1-14 BUT NO LATE FEE UNTIL MARCH 16 2014? The remittance portion of my statement said it was due JULY 24, 2014. My statement is still reflecting escrow. My suspicions that Bayview does not have it all together were confirmed with this one statement. But I paid $1200 of my $1086 agreed upon repayment plan. I immediately called Mayle and asked how much was left so I could plan to pay out of my taxes and by March be ready to make a standard $921 monthly payment (because clearly Bayview doesn't care about their mortgage payers to help them for just 1 month out of 8 years because nothing bad should ever happen to a Bayview Loan Servicing payer and if it does and you ask for help, they will make your life a living hell.
Mayle ** quoted me upwards of $2800 to get current. I asked why, she said I was escrowed and had to finish paying for that to get back on track. I reminded Mayle about months past of me providing this info she requested to get unescrowed. She acknowledged, said to call back Friday and she would have it figured out. I called back Friday, she still said I had to pay the escrow because it was going to take a while for review. I asked Mayle why she didn't help me, I told her I felt she was deliberately doing this. I told her she had no compassion and all I wanted to do was pay my mortgage payment. I told her I did the right thing by contacting them before I knew a financial hardship was coming and all I wanted was for her to help me get it back to where it was but she will not follow through with what she tells me she will do, she will not manage my account appropriately, she keeps making me do the same thing over and over again and she will not even call me back.
I asked her why she would not help me and why she won't get it taken care of. I asked her why I keep getting the run around from her. I told her I was tired of chasing her down just to get the same scripted response from her each time. Her reply to me was, "I'm not the one calling you; you keep calling me so stop calling me." I attempted to get help from someone else because Mayle clearly didn't want to help me.
Every time I called, I got transferred to Mayle's voice mail. I was finally able to put in an incorrect account number numerous times to talk to someone else but each time they asked for my account number, they immediately transferred me to Mayle's voicemail. Eventually I started each conversation with, "Don't transfer me to Mayle **. She told me to stop calling her." This got someone to listen to me before they immediately transferred me. Of course neither Heather, Sergio, Jose, Douglas, Jusette, Kyle nor Guillermo could help me. Trust me, it is not for lack of trying to get this resolved on my end. As you can clearly see, I do everything Bayview has asked me to do. I am paying, I am calling for follow up and status etc. so I am clearly trying to get it resolved and not ignore an issue.
It's March 2014, 5 months later. I am still fighting to get my mortgage fixed. Most of the above mentioned representatives saw the notes or at least some of the notes. Douglas said it would be resolved no later than 3-14-14. I called back, it wasn't. I spoke to Guillermo on Monday 3-17-14 and he said I needed to provide proof of paying my own insurance and taxes. He advised I just continue paying the escrow and once they get it resolved, they will refund me. REALLY? They have been working on resolving this issue for 5 months now. On that very same day, I went to the tax office and had them fax to 305-646-4520 my proof of taxes paid.
I called my insurance agent who three-wayed with Guillermo to have me authorize him to discuss the insurance portion requested. I was assured it was good to go. I called back 3-18-14 and was told that it was received and would be resolved by Friday 3-21-14. It wasn't. I tried to call and get a status but after I got placed on hold, the phone disconnected EVERY SINGLE TIME. After the third time, I stopped calling. On 3-24-14 I attempted to make my ON TIME payment online but my account reflected I was past due and had to call. I was not past due. So I called. The automatic system advised I would be charged an additional $5 to pay by phone. I will not pay an additional fee for Bayview's mistake. I finally got through to Kyle who would be happy to assist me for a $10 fee. I explained why I refused to pay the additional fee, he reduced it to $5, I still refused.
He finally waived it and I paid my MINIMUM payment. Kyle said it was noted that it would be resolved by 4-4-14 AFTER I SUBMITTED ANOTHER LETTER REQUESTING NO ESCROW. I asked Kyle why I had to submit yet another letter, I had already submitted multiple times and Guillermo and Mayle should have copies. He said it was his experience that if just do what they say, it goes much quicker. I asked him how many times I had to submit it, he said he could only advise me it would be better if I just submit it again. I DID NOT submit another letter as I am tired of being the butt of Bayview's jokes to see how much of a puppet I will be for them.
March 24, 2014, I received a letter from Bayview thanking me for being a valued customer and that they received a request for MORTGAGE ASSISTANCE ON MARCH 21, 2014! This never happened. I did request assistance since OCTOBER 2013 and was denied. The letter also advised me that should they need additional information, they will be in contact with me within 5 business days. Really? I have been chasing them down for 5 months JUST TO PAY MY MORTGAGE. The letter also promises IF I PROVIDED COMPLETE INFORMATION, THERE WILL BE A RESOLUTION NO LATER THAN 4-4-14.
At the beginning of this ordeal, I never expected I was going to have to go through this. I had always paid my mortgage, I had never had any issues because I never communicated with Bayview. I just paid. I trusted Mayle when I first initiated contact to get a 1-month extension and she steered me toward a modification. I thought I was doing the right thing by contacting my mortgage company instead of going deliberately delinquent and not paying my responsibilities. Because I never anticipated my life to be turned upside down, I was negligent in keeping accurate records in the beginning. Due to my inexperience, I failed to log each contact but I know when I am being done wrong and I do have copies of everything I have signed and faxed in, just not each date and who I spoke with initially.
Who knew doing the right thing would turn out to be one of the biggest mistakes I have ever made? I now understand why people give up. I understand more why mortgage companies make your life miserable. I understand why people don't more often try to do the right thing. I won't lie, the thought has crossed my mind to find a lawyer to look into this. I don't know how though. The thought to walk away and let them have my property is heavy on my mind. I can rebuild my credit eventually. I can let another homeowner take the $18000 home repair costs while I pay less for rent. It would be better for my finances, my stress level and my emotional well being. But this is my home. What should I let a shady company take it away from me? I need help. I don't know what kind or from who but I know something is not right at Bayview Loan Servicing. IF ANYONE KNOWS HOW, WANTS TO JOIN FORCES AND TRY TO DO SOMETHING, LET'S BAND TOGETHER!

Well, I became behind on one payment. I tried to talk to representatives to change my due date and they couldn't do it or didn't have the time. My husband was ill. I went to a lawyer to have them talk to Bayview since they were not cooperating and to secure my assets and lower my payment and got screwed by both the good for nothing lawyer that did nothing and took my money and Bayview that had no time to talk to anyone and didn't care. I became more than 2 months late and I flipped out. I have posted and called every department even the FBI because it was a scam. I felt that they wanted the house to resell since they do that!
Deutsche Bank is who they deal with. It makes them more money and the lawyer had told me he knew them well as if to say they do this to a lot of people. So I called them again. I asked to pay. They refused to take $ and said that I needed the full amount or they would put it towards something else so I sent them a certified letter with a check for some amount and on that check, I wrote this payment is for my account # and so to be deposited and must go towards payment for mortgage # and they received it and it worked. That's when it started to get worse with them.
They acted like they wanted to help me but tried to make me feel incompetent. They said I didn't understand them and that they couldn't talk to me. That's what they said. I allowed them to speak to someone else in my family and they seemed okay with them because they do not know anything whatsoever and basically said yes to everything. I ended up paying my back mortgages and they in turn now charge $100 extra for processing each month. You are dealing with a money hungry business.
My advice is never refinance ever, never use a broker even if it's your friend, and know that if you act dumb on the phone, they will listen to you or at least act like it but beware they do not deal well with people who know a little about their rights. Check the complaints in BBB. Banks cannot deposit a check to use for something other than paying your mortgage if it states it on the check itself. Sending extra to pay down? Beware. This bank has penalties up to $40k for paying early. Have problems, ask for your signed original and see what happens.

I had been paying my mortgage on time since 6/2004 then due to the fall of the housing market. I inquired about a loan modification due to my home being upside down. I had stop paying for three months to be able to qualify for the modification once I completed all of the hardship package. I had to wait almost to get a poor response. Bottom line, I end up getting my own lawyer to get information from Bayview and found out that they needed to sell my mortgage to another mortgage company. This lead me to have to end up selling my home as a short sale due to the very poor customer service and response from Bayview loans. This happens as a result of mortgage companies selling your mortgage to other companies which I had no control over.

In August of 2008 I tried to refi my mortgage and was turned down. I tried contacting the company and since the answer was no, I had to file for relief. I file a Chapter 13 and included the house. Ever since that I have not seen or came near the house. After filing for the Chapter 13, the loan has been sold several times, and I have been trying to get my name off the house. I have been trying to clear my credit, and it all keep coming back to the house. I can't seem to get ahead with them not moving my name off the property. The loan when I file was with Country Wide. I file Chapter 13 May 14, 2009, With ** of ** PA 18360, I made all the required payment to the Trustee ** over a period of 3 years. I was discharged. Now I don't have or want the house, but can't seem to get my name off of it. I need all the help I can get from anyone. There should be a law to stop companies from this practice of selling loans that have been included in a relief process.

They are committing fraud and seizing homes for nonpayment because they never answer nor return calls, their website to pay is bogus and just there for show. Everyone needs to file a complaint with the Florida attorney general's office, and the Florida FBI. This can all be done online, I filed my complaints today. I've been trying to pay my mortgage since last month. Wasn't even 30 days past due (because of their neglect) they won't accept the payments. I was a victim of mortgage fraud in 2009 and it's very similar to what happens before. Sign complaints, we can all do something about this nonsense if we stick together and prove they are scams.

I would gladly enter into a class action lawsuit against Bayview. They all of a sudden one month started charging me escrow, from day one I paid my own taxes and homeowners. I faxed proof of payment to their tax department and their insurance department. I continued paying my normal monthly payment. They then put me in foreclosure. When it was finally figured out, they continued to charge me for my homeowners. I paid because if I did not I would have been put in foreclosure again. In September, I changed insurance carriers, which I paid. Sent proper paperwork to Bayview but they kept charging me the escrow. I finally got it straightened out, they were to refund my monies.
I called two weeks later and was told the check went to my old insurance company, nobody knows why. I called my prior insurance company, they said they never received the check. I am in limbo. Another problem I had a claim over a year ago, my basement was destroyed by water, it is going to take about $50,000 to bring it up to speed. I have to self contract because I only received $12,000 from my insurance company which Bayview is holding in an interest bearing account! Sent them proof of work done, they said they would release the funds, I have called, I have emailed... no response. This is not a good company to do business with.

We were sent to BV by BOA in June. I only found this out because BOA sent me a letter. I never received one piece of paper or information from BV. I called them because I knew we were under foreclosure and wanted to check if there was a sale date and was told to call back and ask for someone else and talk about a modification. I did this every other day for two weeks. I left numerous messages, no response. I called the main number back and was told, "Oh, well they don't handle your loan, so and so does". Yeah, right. Again, a month of calling with no response. I finally got one person on the phone who told me to send in information for a modification. They claimed they never got it, so I faxed it again, and received no response.
After months of this, we find out there is a sale date on our property and my husband and I gave up and decided to move. We were planning on moving all of our belongings out before the sale date, but we live at over 10,000 ft in the southern mountains of Colorado and the weather can be hard to deal with in the winter. This was in November. The sale date was November 20th. I called the attorneys that handled the foreclosure, explained the issue and asked about eviction procedures. I was told it takes almost 30 days or longer usually, but they didn't have any eviction papers on us. I asked what happened after they got them from BV and was told that I had to be either served personally by the sheriff's department or the notice had to be posted at the residence. None of this ever happened.
We had a really long steep driveway and every mover we called claimed that even if the driveway was plowed really well, they would have trouble getting a truck up it. So we got our own truck lined up, found a few friends willing to help for a small amount of money and beer and planned the move. It then snowed every week for the next 4. So all this time, I am checking the property, taking some things and making sure there were no notices. So the week we get a break in the weather, my husband goes to check what we need to do to get the driveway under control and found our locks changed and the driveway plowed well enough for a SUV to get up it. I called BV and asked about notification. The guy I got kept asking for my account number, I said I don't have it, all my paperwork is in the old house and it's locked!!!
So after the 3rd time, he asked me, I got a bit snippy and said, "I still don't have it, look it up another way." He told me that "I would get nowhere with that attitude". I was stunned actually and said, "Ok, enough, let me talk to a supervisor." He says, "No, I won't let you and we don't have to talk to you at all" and then he hung up. After several minutes of admitted cursing, I called the Sheriff and the county court to find out if they had received ANY paperwork. They had not. So here is the big kicker. We went by a few days later and found our house trashed. Our bed (mattress and boxspring) was lying in the snow on our old porch. The microfiber couch was upside down on the railings, one of the chairs that goes with the couch had the back ripped off.
My husband went and looked in all the windows and found everything else had been bagged in construction trash bags or was gone. He went to his tuff shed and ALL of his tools were GONE. I don't mean in bags, or in storage waiting for us to pay the storage fee and get them back, but GONE. We had a 5th wheel on the property that belonged to a friend, it was also gone. I called the Sheriff again, the court again and the lawyers again. Their own lawyer had trouble getting them to respond. I finally got a call from a man named Marvin, who asked me what my issue was and that it shouldn't have taken that long to get our stuff out. I said it's been 5 weeks since the sale, and it has snowed every week, not to mention that there was Thanksgiving, Christmas and New Years in there. He also told me that his "agent" had told him that the house only had debris and trash in it, nothing of value so they didn't need to post eviction papers.
I of course told him that was a big fat lie and proceeded to give him a small list of the furniture, tools and clothing left there and he kept saying, "Well why didn't you come get it?" So he knows it was there, but is saying his agent says nothing was there. If he wants to know why I didn't get it, then isn't he admitting to actual furniture and stuff being there? I told him that if the week before when I had called and told them I wanted to come get my stuff, the guy had let me instead of hanging up on me there would be no issue. So anyway, I need help. We have lost everything and I need to know what my recourse is, if any.

This company is a virtual nightmare and should be put out of business. If I could join a group, in a class action lawsuit, I would do so. After submitting documents over and over for a year to JPMC, but with only one response, I received notice that they had sold my loan to Bayview Loan Servicing, LLC. They began calling me to tell me I was in foreclosure. I contacted them and spoke to someone (I was told there are many by this name) named "Carlos." He was not polite, dismissive and barely literate. When I told him I wanted to sell my home on a short sale and needed to know what amount would satisfy BV, he replied, "Ahhhh, $410,000." This seemed unusual and I had no idea how he arrived at this figure, but nonetheless, I asked him to send me documentation to this effect. His response was "I no send you no paperwork," to which I replied, "I have to have documentation if I am to put a price on my home to satisfy BV."
He then replied," Ahhhh, do a loan mod," to which I replied, "I don't want to do a loan mod, my husband is now disabled and I have lost my job." Next reply, "Do a deed in lieu." After his limited explanation, this did not seem to be what I wanted to do either. It was as though he was going through a prompt book and had NO idea what he was talking about.
I then hired an attorney to see if he could find out what the status of the loan might be. Checking at the courthouse, he found that the referee from JPMC asked the court to dismiss (w/o prejudice) the foreclosure. No one had notified me of this, prior to my attorney reading the court documents. My attorney said, "The only way this could have happened is if JPMC does not have the original documents and they cannot foreclose w/o them. This happened a lot after the depression and the Civil War, when documents were lost. The mortgages were known as Zombie Mortgages."
Nothing happened for months, but a few calls from Ricky ** and Carlos, who would not call my attorney unless I sent them documentation allowing them to do so. This is understandable, but they insisted it be faxed, not emailed. Since an email can be used as a legal document, this surprised me, but not entirely when it can to BV and Carlos. When my attorney contacted me in June, it seems BV wanted permission to do an appraisal. This was granted with the agreement that BV would send us a copy of the appraisal. They never did.
In August, I received a letter giving me less than two weeks to agree to either a short sale at $375,000 or a loan mod at $396, plus advances (??) they have made. My attorney went on to write, "He (Ricky) could not tell him what the number was over the phone. I assume it would still be quite substantial and probably at least in the $500.000 range." The property, which has been in my family for over 47 years and is 100 years old, was scheduled to be auctioned in less than two weeks, on Sept. 5! I had just received a handwritten envelope with my name and address on it stating this fact. Nothing from the court was sent to me.
A week later, my attorney received notification from the court. Leaving us ONE WEEK to negotiate something. It seems an attorney for JPMC had surfaced and stated in court that they now had the proper documents to proceed with the foreclosure, which was granted. The unusual thing was that this document was written two years prior to being filed and ON THE SAME DAY that they asked the court to dismiss the foreclosure. "The right hand just didn't know what the left hand was doing, Your Honor." (In April, I had received $1000 as part of a settlement from a Class Action lawsuit against JPMC, for improper business practices, etc.)
Immediately after this, my attorney asked Rickey ** for cash (we were up to $20,000) and a waiver of the deficiency when Ricky stopped returning calls. Many calls went unanswered. Emails were not returned either. When I finally called him myself (the day before I filed for bankruptcy and the auction). He yelled at me that he "had other paperwork to do and that (I) should have done this months ago!" I said, "I only learned of it two weeks ago." He continued yelling. I asked him to call my attorney because I was going to file for bankruptcy to stop the auction. Amazingly, he called. Of course the same words were exchanged between my attorney and Ricky. When my attorney said, "My client is going to have to file for bankruptcy," Ricky yelled, "LET HER!"
I proceeded to file, knowing that this was the only way to prevent BV from coming after me for the deficiency which was over $300,000. Their word means NOTHING. It is a constant SHELL GAME. I have documentation to prove it. After I filed, we contacted BV again to see if we could continue to negotiate. No, Ricky was not handling this anymore. We were to talk to Daniel ** who handles Bankruptcy cases. As was the usual case, he was very difficult to reach and did not return calls easily. To have any money offered for a DIL, I had to submit a Hardship Document. Of course Ricky ** never had mentioned this at any time. They then did a title search. We are still waiting to hear from them.
The most interesting part was THEN receiving a letter from Daniel introducing himself and telling me he "could help me with a loan modification if I would just call the number below." The night before the bankruptcy court appearance, I got mad. I began calling the number at the bottom of Daniel's cheery letter. It is at a call center in Tennessee. I called and left a message four different times with four different people, going higher on the chain, each time. I finally received a call from a VP (Sergio ** 877-243-5488) at 6:58 pm. He listened to my story and told me I did not need to call his boss (Chris **, Managing Director) again, that Daniel ** would return my call or my attorney's call. If not, I was to call him back on his direct line. Daniel did not and my attorney called Sergio at the number above. Daniel responded the next day by calling me (which I had asked him not to do, but to "please call my attorney"). He said, "Let's just forget the past and move forward." Oh Please.
We wait. I have sold furniture to pay for a rented truck to move, lost my home, moved out entirely, filed for bankruptcy and still have NOTHING FROM BAYVIEW. This is the WORST COMPANY IN BUSINESS. Someone should put a stop to what they are doing to the public. If anyone has suggestions, please let me know. I might add, bankruptcy is the last thing I ever thought I would be doing in my life. I was not raised to do anything like this. I know how damaging it is and that it is public knowledge. I am humiliated and at 66 years old, I do not need this emotional trauma in my life. My husband is having heart issues and will be hospitalized in the next week. The stress is unbearable. The bankruptcy court attorney asked for the appraisal. When he was told Bayview would not give it to us, he smiled and said the "Court will subpoena them."

Bayview Loan Servicing LLC accused me of not making payments for 13 months. I received a loan modification from them... I agreed, signed the papers, made the necessary payments. They instead didn't apply the new mortgage payments and started foreclosure proceedings. I spoke to an Alex ** who is an absolute nightmare and in charge of my file. He refuses to even believe I made any payments at all. I have proof of payments, a copy of the loan modification agreement as well as a copy of my loan transaction history which show I made the payments. Help is surely needed. They are trying to steal my money and foreclose on my house.

My nightmare began with obtaining a home mortgage through Taylor Bean & Whitaker. Apparently they were not adhering to federal guidelines when handling residential mortgages, and according to the press reports when the government shut them down, the majority of the money and principals wound up in the Cayman Islands. When the government shut down Taylor Bean, my loan was transferred to Cenlar. After having my loan for about 2 months, Cenlar advised me that my mortgage payment was going to increase approximately 30% due to an escrow shortfall. According to Cenlar, Taylor Bean had not been adjusting my escrow account and payments when my taxes went up for 6 years, causing my escrow account to be short. This "shortage" was then added to my monthly payment as I could not afford to make a one time payment of the shortfall. This was about the time of the "mortgage crisis/recession" so as my mortgage payment went up 33%, the value of my home fell 66%.
I contacted Cenlar several times to see about doing a loan modification and each time was told that they would not modify my mortgage while I was current. I was told to stop paying, wait until I was 60 days past due and then recontact them. At that time they would do a modification for me. I did as they said, and became 60 days behind. After talking to several people at Cenlar who were less than helpful, I began receiving mail from Bayview. No one had told me that Bayview was going to be handling my loan for Cenlar, so the first couple of things I received from Bayview, I threw out thinking they were the normal refinance junk mail you get when you are behind on your mortgage. Finally I figured out that Bayview was acting as the agent for Cenlar and began speaking with Andrew at Bayview.
Andrew was at times helpful, and at other times combative depending on the day. In the beginning I was happy, because it seemed that I had finally found the right person to talk to to solve my issue, and he knew exactly what to do. Andrew mailed me a packet of paperwork which I filled out and returned via fax with all of the additional items he had requested, such as pay stubs, etc. After a week or so, Andrew called and gave me a list of additional documentation he would need, including several documents I had already sent in. I faxed all of the new documentation and re-faxed the other documents. Another week went by and Andrew stated I had to send in new bank statements because even though I had sent him 3 months' worth of statements only 2 weeks prior, it was past the first of the month, so I had to send in another month's worth.
I faxed in another month's worth, and was told I had to fax in all three months again, even though I had previously faxed the first 2 months. Andrew would then tell me he was submitting the file to pre-underwriting. About 2 weeks would go by and invariably Andrew would tell me that he needed a copy of something else, and by the time I got him that document in a day or so, I had to re-fax other documents because now they were too old to be used. This "cycle" continued for 6 months. Once Andrew said I had to fax him all new bank statements because I did not fax a blank page of paper at the end of the statement. He kept telling me that the loan modification was looking good, that there was no need to make any payments to Cenlar during this process, that he was sending my loan to underwriting, and that I could ignore any letters I was receiving from Cenlar's attorneys about foreclosure.
After 6 months of faxing and re-faxing, Andrew finally told me he had all of the necessary paperwork, and had submitted my loan to underwriting on Monday, and would call by Friday to let me know their decision. I waited a week and a half and didn't hear anything, so I called Andrew. He went to look up my loan in his computer and told me that the loan was no longer available to him, that Bayview was only given 6 months to do the modifications by Cenlar, and that Cenlar had taken my loan back, and I should contact Cenlar. I asked Andrew if I would have to start this whole process over, and he said no, that when Cenlar took the loan back they would also get all of the documentation I had submitted to Bayview.
I contacted Cenlar who at first told me they had all of my documentation, and the loan would go directly to underwriting. A week later when I contacted Cenlar they told me they had none of my documentation, and that if I wanted to do a loan modification I would have to start over. Currently, I am trying to work out a short sale on the house. I am not sure who I am more angry with, Cenlar or Bayview. Cenlar is terrible to do business with, and they do not communicate well. Bayview wasted 6 months of my time, not to mention all of the frustration involved with all of the paperwork, and also probably cost me the chance to keep my house by taking 6 months to accomplish nothing. I would never do any business with either one of these companies in the future.

I am needing to have a loan modification done. I called my mortgage company and they sent the necessary paperwork and we filled everything out and sent it back. A few days later, we get a letter saying that the company who will be handling the loan modification is Bayview Loan Servicing and that we will be contacted by them in a few days. So we go on with life and I realized that I have not gotten a call or a letter in the mail from Bayview, and it has now been over a month since we received the letter from our mortgage company. So we call them and we were told that there was glitch in their system and that they fixed it now since I called them and that they have received our info. I was told who my go-to person was, and his direct number.
So I called the Go to Guy and it went to voice mail, and I left a message and asked to be called back asap. Well, I have never received a call from the Go to guy or anyone else from Bayview. I have called them at least 20 plus times and have yet to speak to anyone who knows something about my info, or even spoke to the guy that is supposedly handling my case. I am frustrated and trying to get help to keep my house. I can honestly say this is one of the worst companies I have every tried to work with. I have since been looking for another company to help me.

I was subjected to Bayview Loan Serving LLC back in Feb. 2013. My mortgage company, CENLAR, they processed my loan 5 to 8 days late, because they can't seem to handle mail transactions in a timely manner. They suggested maybe a loan modification would "help" me. I thought why not, I can lower my rate, what could be bad about that. I was wrong , Bayview Loan Servicing LLC IN Coral Gables, FL managed to extend the process 8 month plus and lose personal financial documents that were sent to them via United States Postal sent registered return green card to sender, signature required. These papers contained My wife's 2 months of pay stubs, my social security proof of deposits (direct copies of my checking account) and Medical documents of bills on a payment plan and medical information, Doctor's diagnosis, medications etc. that meant personal financial information was in someone's hands but they do not know till this very day where they went. I have the initials D. G.on the card plus the ref. # of the postal transaction, telling day, date and time they signed for it .
My asset manager, Mr. Joseph **, assigned to me never returned 8 messages sent on 8 consecutive business days. He also had 2 different e-mail addresses to choose from and two phone numbers he could have called. He did not do any of the aforementioned. When he called 2.5 weeks later asking me where the documents were, I was very agree to say the least. He now told me that if I resend the documents, they would have to be updated as the lost information was out of date. They told me first verbally that I was accepted by phone and then by mail to start a 3-month trial period, at the reduced rate and would not receive papers to have my attorney examine until January. I was told not to pay my regular monthly payment to CENLAR and Begin on Oct. 1, 2013. However there would be no grace period, and one day later than the first, the deal was over.
Firstly, I told them that due to my wife's pay periods and my social security payments varying every month, that was not possible. Now for the kicker, after the three months if I don't want to proceed for whatever reason, I would owe them the difference between my lower payments and my current of pre-trial period, Which would amount to some $800.00 plus my regular mortgage in January. Also the three-month trial period would be reflected in my credit as partial payments and be reflected in my very good credit score. Why would I want to accept such an offer? Why would I want to do business with them since I have no trust in their company and could very well cost me between already spent $10.00 plus in postage and FedEx the 800 dollars more. Forget about it. I have not signed any documents of agreement to such terms nor do I plan to sign any documents in this matter. Beware, they have an F rating with the BBB and a warning posted in red to beware of this company.

My mortgage company transferred my mortgage to Bayview. I made a telephone agreement for the first payment. They took two payments. When I notified them they told me it would take 48 hours to return my money. It took three weeks and I received it through the mail. I notified them that I had an additional charge from a check bouncing and have yet to receive it a reimbursement. I tried to notify them of the issue and the representative told me my situation was impossible. I am exhausted now but in a few weeks will pursue my reimbursement.

My loan was transferred to Bayview by my local bank. First, let me state that this was not a mortgage loan and should never had been transferred to Bayview. Major problems started in June of 2012, when I kept receiving delinquent notices from Bayview. My payments are made by my insurance company (I have disability insurance on the loan). When I called Bayview about the first delinquent notice, I was told that they had not received the payment. I then called my insurance company and they told me it had been sent and the date they sent it (I also receive copies of the payment date and of the check sent). In July, same scenario. Every time I called Bayview, I got a different person and a different explanation.
On probably the third call to them in July, someone actually looked at the account and noticed that the numbers in the payment had gotten transposed and the insurance company was shorting the payment by 45 cents (yes, cents). This had been going on since 2009 and no one had caught it before then. I immediately called my insurance company and they sent a check in August to Bayview for the difference dating back to 2009. This was after I had received a delinquent notice for August, as well as was told they had not received payment from the insurance company. I called my insurance company again and was told that not only had Bayview received the checks for June, July and August, but they had cashed them in a timely manner but never posted them to my account.
After I called Bayview back, everything was miraculously posted to my account. When I called them out on telling me they had not received the payments, they got irate with me. Well wouldn't you know it? In October, I received another delinquent notice stating I owed October's payment and a $10 late fee and a $20 NSF fee. Once again, I called them and told them that there was no way the checked bounced and it comes from a big insurance company. Well sure enough, I had to call my insurance company and call Bayview back. This time I actually had a very nice woman (Donna) who helped me and checked into things. She stated that the check had not been returned for NSF, so she erased the late fee and the NSF fee.
My loan is nearing its end and there is a discrepancy in the amount owed. Bayview thinks that interest is accruing and I keep telling them that it is not a loan that accrues interest, but like a car loan, it has set payments with the interest included in that payment. They now want me to send a copy of my original loan papers. This was told to me today even though I have been trying to get an answer on this since last summer and have been told by supervisors and also requested through the automated system a copy of my payments since the loan was taking over from them. Of course, I never received them. I was also told that a woman (Leslie) from Harris Bank would be contacting me (this was on 1/15/13) by 1:00PM. The next day, never heard from her. I called back the next day and she was unavailable, but would call me back. I have never heard from her either; not sure if she even exists.
I just don't understand why all of this hassle is on me. I am very frustrated with Bayview and I would encourage everyone not to do business with them. I'm still dealing with the frustration and wondering if this loan is going to be paid off in April as stated in my loan papers (which I am sure Bayview already has a copy of, although they want me to send a copy to them. If I was working and have access to a copier and a fax machine, I would do it in a heartbeat. But I am not sure even this will help). You cannot trust anything they tell you.

I had a loan with Yale since 2004. In 2009, l lost my job. I was falling behind. So, to help me, Yale lowered my payments to $600 for 1 year. In this grace period, Bayview took over. l got a phone call saying I'm 3 months behind. So, I checked my bank statement. All checks had cleared with no missing payments. I called them and no one could help me. I left voice mails and spent all day on the phone. Weeks went by and I got a phone call. I explained that I had made all my payments. They said, "You only sent $600, partial payment." So, I sent them a copy of the contract that I had with Yale. They responded: "That was between you and Yale. We are not going to honor that contract."
I did not know that my paper had been sold. Now all of a sudden I'm three months behind. Bayview said that with late fees and attorney fees, I need to send $5,648 today. I'm out of work and having trouble making the $600/month payment. So, I'm going to court on Oct. 18 without an attorney as I cannot afford one. Please say a prayer as it's all I can rely on now.

This company took over our mortgage a little over a year ago. In October 2008, they decreased our monthly payment by $150/month stating we were paying too much in escrow due to a decrease in our insurance premium which created a surplus. Considering our insurance only went down $500 per year and they were reducing my escrow by $1800, I found this concerning, but they assured me this was accurate. Twice this year, I questioned them when I first noticed a negative escrow balance, but was again assured everything was fine. Then, earlier this month, I got a letter stating they are increasing our payment by almost $500/month. They claim we had an escrow shortage of almost $4,000 by May 2009.
How can a decrease of $150/month over eight months result in such a large deficit when other than a decreased insurance premium nothing else has changed much? I have owned this home 11 years and never had any issues with our prior mortgage companies. Now, their mistake is going to force us into foreclosure, which I did explain to them. If you can not assist me with this matter, do you have any advice as to where we can turn? We are willing to work with them even though we did not create this situation. Despite my attempts to reach out to them, they are unwilling to work with us. The best they could say was sorry for the inconvenience.
