eBay pulled a listing of mine for what they called a counterfeit item. It was NOT a counterfeit item and there is a full page of the SAME item listed for sale.

I have been a successful eBay seller for about 7 years, earning "Top-Rated" seller status three times and a feedback rating of nearly 15,000; 99.5% positive. Unfortunately, as a result of of eBay's newest policies that went into effect this past Spring, my business has taken a severe hit. And here's why:

Following a successful holiday season of numerous sales, I compounded many non-received item disputes in the UK. Being that I did not resolve them correctly according to eBay, despite the fact that they all received full refunds, my percentage of disputes opened caused me to have selling limits both in amount I could list and dollar amount. I literally woke up one day in April to realize this. No warning. Nothing!

A former top-rated seller who pays ebay OVER $3,000 a month in fees, blasted just like that and still now in late August, I am fighting to get my privileges back amidst being given the runaround by eBay customer support who keep telling me to wait until the following month. And while I have been constantly working my ** of to better my business, I continue to take more hits and downgrades due to eBay's "automated" system of percentages. Even if you handle dispute correctly and even if the buyer is at fault but opens a dispute regardless, the seller takes the hit on his/her account! It is all about BUYER PROTECTION now. They care nothing about sellers. They care ONLY about money, money, money.

eBay is a monopoly who cares nothing about hardworking sellers like myself who get them where they are. They are disgusting and there are too many reasons to list as to why in this complaint. Please contact me for further info. I have been financially and emotionally devastated as a result of eBay and could go on all day about it.

I have been a seller on eBay for about five years and I ran into some financial problems. I almost lost my house and called eBay to tell them that I was having problems paying my fees. Well at first, they worked with me. I paid $100.00 which left me with $400.00 that I owed.

Now, I was averaging in sales around $7000.00 a year part-time. In a month, from the time I called and set things up, they suspended my account for $400.00. I called back tonight since I have everything fixed and now they are telling me that they sent my account to collections for $400.00.

I am a small business owner and that really looks bad for me now. They could care less about their customers. Needless to say, eBay is a multi-million dollar company and they sent me to collections for $400.00.

I never had an eBay account before. However, my account was just suspended, while having 100%, claiming that I have some other account linked somewhere. When I called in to have it taken care of, they said they have proof that the other account is mine or a family members'. However, due to privacy policies, they won't tell me what this so-called proof they have. I now have a fraud/identity block on my bank and credit card companies due to this. I even had to contact an attorney about this. And I am currently working on what can be done.

I am a vendor. I sell digital media including DVDs. I buy from and vend for several manufacturers. I sold a factory sealed DVD manufactured by Vanguard As. I deal directly with the manufacturer. The product is an authorized one under copyright. I had the sold item returned to me. The buyer said it was a DVR or burned copy. I refunded the buyer upon the return of the DVD. The buyer posted feedback, stating that I sold a DVR which is an illegal act. I asked the feedback to be removed, but eBay asked me for a court order. I then asked for the buyer's contact information. eBay provided me with false information about the buyer - fake address, phone number and even a fake name. The information given to me is Larry ** with a phone number that is not a genuine phone number. eBay refuses to provide the correct contact information. eBay is asking me to file for an injunction from the court to have the feedback removed.

Sellers do not have any rights on eBay. That is a fact. Very recently, I had the misfortune of having an unscrupulous buyer file a claim through eBay. The buyer, eBay user name "**" or E.J. **, **, claimed that the item I shipped, a crossbow, was damaged in shipment due to my lack of proper packaging. Despite contacting eBay and trying to explain that the buyer was abusing the eBay buyer protection policy, they still decided the case in favor of the buyer. This is the last straw in the many incidents with eBay and I will be closing my account. PayPal, you are addressed in another complaint and are cancelled as well. Details of my case are listed below and you decide if eBay did the right thing.

I sold a Barnett Commando Crossbow on eBay. I packed it with multiple layers of bubble wrap and cardboard reinforcements and shipped it. It was very hard to damage, unless you ran it over with a vehicle. I get an email from the buyer stating that the item arrived damaged. I replied, stating that I apologized for the inconvenience and to do some things for me: 1. Take a picture of the damage and send it to me. 2. To hold on to the package and item until my shipper, FedEx, could inspect it. The buyer ignored my requests and shipped the item back as soon as he could.

I received the item back and saw that the prod or "bow" part of the crossbow was completely broken into two pieces. Now, this prod is made from a thick solid piece of fiberglass and is nearly impossible to break unless you "dry" fire the crossbow or fire the crossbow without an arrow. There was no other damage on the crossbow or scope. I find it highly unlikely that the item was damaged in transit. If it had been, there would have been other damage, especially on the scope as that is the most fragile item on the crossbow setup.

Also, the buyer did not send back the string. I've been actively involved in archery for the past 30 years, and I know that this damage was not caused by the shipping means. The damage was more than likely caused by the negligence of the buyer or purposely committed because of buyer's remorse perhaps. Anyhow, despite all of the correspondence that I sent to eBay and the pictures and documents that I had to prove my claims, my claims were all ignored. Getting live help on eBay is task in itself as well. I don't know who is making these decisions at eBay, but it will eventually cause their downfall.

eBay is now holding funds for items that have been purchased. They informed me that they can hold items for up to 21 days. In the past, I sold an item and then the buyer paid and then I would ship. Now, I sell, the buyer pays, and eBay holds the money until it's shipped, buyer is happy, or they decided to give me my funds. eBay is also charging fees or a % on the shipping cost (tax or tariff on a services) that they have nothing to do with.

I have been a seller on eBay since 2002 and have never had a problem with my account. I use it to sell an item every two or three months and to teach a community education eBay class. But I am not a heavy eBay seller. On July 9, 2011, I received the following e-mail from eBay:

    "Dear ** (**),

Based on your account information and activity, it looks like user ID ** is associated with your account. This usually indicates that both accounts belong to the same person.

Because the other account is restricted or otherwise not meeting minimum seller standards, we've changed the amount you can list on eBay.

You can now sell up to 15 items or up to $1,000.00 per month, whichever comes first. After 90 days, we'll reassess your account and may increase your limits based on your selling performance. You can also increase your limits sooner by resolving any open issues with the associated account. We've already sent instructions for resolving these issues to the email address registered to that account."

The other account that the e-mail is referring to belongs to my brother. I am not linked to his account in any way, shape, or form. Since I had no idea what account activity eBay was referring to in the e-mail regarding activity on my account, I called customer service and spoke with a customer service representative who assured me that since I called in and let them know that my account is not linked to my brother's in any way, the restrictions on my account will be removed. I asked the representative why eBay thinks that my account is linked with my brother's account, and she said it's because we have the same zip code. I told her that people who live in the same city usually do have the same zip code, and so do 60,000 other residents who live in my city. Some of them might also have eBay accounts. I asked her if eBay restricted their accounts as well because they all have the same zip code. She talked very fast and refused to answer any of my questions.

I needed to sell one item in early August, so I listed it. The customer service representative lied to me because the selling restrictions are still on my account. I contacted my brother to see if he knew anything about this issue and he stated that he owes them $113.00, which he can't pay, so they suspended his account. So what this boils down to is that eBay punishes the family members of people who don't pay their bill.

I filed a complaint with the Better Business Bureau which resulted in the selling restrictions remaining in place on my account. Nick **, which I have excellent reason to believe is an auto-responder instead of a human, stated in eBay's reply to my complaint that since my brother and I have the same financial and registration information, the restrictions will remain on my account for 90 days when they reassess my "seller performance." I don't know what they expect my seller performance to be like in 90 days because it wouldn't have been any different than it has been over the years I have had my account.

The auto-responder "Nick **" also provided links to increase my seller limits with one link wanting personal information to verify my identity. I provided the information but their system refused to accept my phone number, which is the exact same phone number that I have used for eBay since I opened my account. I kept getting "this number is not correct" so I gave up on even trying to do anything with the links to increase my seller limits and resolve this issue.

My brother and I do not have the same financial information, nor do we have anything in common in our registration information except for our city and zip code. He has his household and I have mine, and we rarely see or talk to each other. In their final reply to my complaint, eBay stated that they have the right to restrict accounts when the accounts are linked by members in the same household, and members who have the same registration and financial information. They won't listen to me that my brother and I do not have anything in common in our eBay accounts except that we live in the same city. I even sent them a letter by postal mail in July which they never even acknowledged. eBay has a one-way system against sellers which is not ethical or fair. What my brother owes them or does with his account isn't my concern yet I'm being punished for it. They say that I own his account, yet they refuse to provide me any proof of ownership whatsoever, or even talk to me any further about not punishing me for my brother's actions.

I won an auction for Adobe software and immediately paid so the item would ship. The next day, eBay sent me an email indicating that they had removed the item from the auction because they believed it might be counterfeit. eBay removed all record of my purchase including the amount paid, the item # and the seller's identification name.

I opened a complaint and also communicated with the seller, who said he would provide a 100% refund once I returned the item. I returned the software to the mailing address on the package I received, ensuring that I used delivery confirmation.

The package was delivered to the seller 1 week ago and I have yet to either receive a full rebate of $117.50, or any further communications from the seller. The eBay complaint site also "determined" that they would not provide a refund, although their actions were the cause of this entire situation. And then eBay closed my complaint. I want a full refund.

I appealed a case that was decided against me, the seller. And eBay granted my appeal. I couldn't believe what I was reading. eBay almost never sides with the seller. I was told I would see my funds back into my PayPal account within 72 hours. 72 hours went by and I got no funds. I sent an email inquiring about my funds. And I was told it would be another 48 hours. 48 hours later, I still got no funds. I sent another email inquiring about my funds. This time, I was told that the initial processor made an error in closing out the case. It has been corrected and it would be another 7 days until I receive my funds. I called customer service. I was told there is no way to expedite the refund. What is upsetting is eBay is very quick to take money from me when a case is filed, most of the time leaving me with no funds to spend. I guess when it is a refund to seller, it takes time. This is an unfair practice and it should be corrected.

I have a very bad experience with eBay. I have sold a Mint Sony camcorder for $40. I have listed everything that was included. The TV cable was not included when I bought it new from store. And I didn't say it. The buyer didn't like the video after he had received it. So, he complained that there is no TV cable in it (it is cheap and can easily be found in electrical store). eBay have made a decision to refund payment.

This month, I paid $550 for a ThinkPad W500 computer "in excellent working condition", as the seller said. But the hardware is broken when I have received it. And the seller has mentioned nothing about it. eBay has made a completely different decision than before. They have rejected to return. Then, I have paid $120 to fix it. I have lost $120 on eBay. And they are still asking me to refund the $40. It makes me extremely angry. I will never follow. It is the worst decision, even if I would lose the account. And I will never be an eBayer again. If they have known it, why don't they change the mistake that they have made?!

I put 3 inexpensive items for sale on ebay. None of them sold. I got an invoice for $1.50 seller fees, which I immediately paid through Paypal. I actually accidentally paid twice, so I paid $3.00. It shows on my bank statement that the payments went through. Now they are assessing me a $13.50 penalty fee because they say my fees were never paid. I wrote and explained that they were paid, and someone named James wrote me back and said that the payments never went through and that the $13.50 is a penalty. I wrote him back and attached a screen shot of my bank statement showing 2 payments of $1.50, one right after the other, on my statement. I told him to drop the penalty. He never wrote back and now I received an e-mail that says I am in collection for a fee I do not owe and that I already paid.

A few months ago, eBay started charging "final value fee on shipping" for a seller who charges shipping cost to a buyer, making a huge amount of money (free money) and there is no reason for that. The fee is not in their policy, making that charge a fraudulent one.

I am selling some stuff on eBay and as an example; l sold a 32 inch non-working LCD TV for $79.99 and charged $59.99 for shipping. Now, the shipping cost me $66.28, so I am losing $6.28 and eBay charges me $3.00 for a final value on shipping charge. I am very frustrated.

ebay has decided that the buyer's "opinion" will determine whether the seller is entitled to their money. In a court of law you would need black and white evidence, something tangible. Even circumstantial has to be something more than an opinion. Anyone interested in a class action suit against ebay for holding your money? Additionally, shipping is not taxable so what makes ebay think they can have 9% of the shipping cost? These are very slim planks ebay is operating on. CLASS ACTION SUIT IS WARRANTED!!

But the sellers are the ones who make them the money.

I would like to know if there is anything that can be done about this new rating that Ebay has. Ebay is removing EVERY feedback that I have left for a seller that I didn't leave 100% 5 star ratings, but they DON'T remove the ones that buyers have left for me. HOW can they do this?! What can be done?! I know that Ebay has a personal vendetta against me as I had to inquire with a lawyer before because I was suspended without any cause. I contacted a lawyer and he told me what to say to Ebay in a letter. Ebay HAD to reinstate me as they had no reason as to why they suspended me in the first place. I have had an eBay account since 2006, and I started to sell in May 2011. I have made over 100 sales, have a five star, 100% positive feedback reputation. I sell items in the $2-5 range and offer free standard shipping (stamp on envelope). I have never had a complaint or dispute.

So eBay decides to impose this policy on me http://pages.ebay.com//sellerinformation/howtosell/acceptingpayments/fundsavailability_new.html

All my payments will be held for 21 days now, or until a tracking number can verify the item was delivered. I feel this is a punishment and is discriminating against me for three reasons:

1- When I started to sell, I read the TOU for two hours and never found anything about this happening to new sellers. I was told by a supervisor, Anna, that this policy started June 1st, after I started to sell. And I read all my messages and newsletters from eBay, never once was this mentioned anywhere. I feel they have no right to impose this on me with no notice, no choice to decline and unlist my items. I didn't find out this policy even existed until I checked my sales and saw they would not be released to me for 21 days and this will continue until I have been a seller for 90 days.

2- This policy is punishing me for not using tracking, since the payment will be released after 21 days or when tracking shows it's delivered, whichever is sooner. If I use tracking, the minimum shipping will be $2.77. That is more than the whole cost of some of my transactions. If I charged that, no one would buy from me anymore. Yet eBay allows me to choose standard shipping as an option, then punishes me for using it by holding my funds 18 days longer than if I used a form of shipping with tracking.

3- I will now have to pay for shipping & eBay fees out of my own pocket for the next three weeks until the funds start to get trickle released day by day.

I called to file a complaint and was told there's nothing they can do. I spoke to a supervisor, who said there's nothing she can do, and told me they don't even accept complaints; they only accept feedback, and mine has been noted, thank you for calling.

I told her I'd like to escalate this to her supervisor and she said she doesn't have one. But I could call the corporate office and she referred me to the phone number on the website. I asked what extension or who should I ask for. She said just tell my complaint to whoever answers and they will direct me to the correct department.

I called, and got a message saying press 1 if you know your party's extension, press 2 for customer service. When I pressed 2, I was told to call the number I previously called.

So, that's what I did, and I spoke to a man named Josh. He seemed to express more concern for my complaints, but again told me there's nothing he can do. I asked for a supervisor seven times, and each time he gave me a run around about why they wouldn't be able to help me either and how I have no recourse. I finally demanded to talk to his supervisor, he put me on hold, and came back and told me that this issue is considered resolved on their end, and that I need to let it go. He told me to refer to their legal page if I'd like to sue them, and otherwise I need to not call back regarding this again. He then hung up on me.

I'm absolutely shocked and appalled by their behavior. They repeatedly told me this isn't a punishment, this is just a policy to protect me and my buyers. But it doesn't protect me in any way; it only punishes me by withholding my funds and making me pay out of pocket to continue to sell. And it doesn't protect my buyers--they were already getting excellent service, my feedback proves that. I honestly have no incentive to even fulfill my orders, pay my fees or continue selling at this point. I don't see how that could benefit anyone.

They have no way to dispute this, and that is wrong. I should not be told not to call back and that my issue has been resolved when it absolutely was not. I was just told repeatedly how this is a good thing that will benefit me and all eBayers.

I have been selling on eBay for a few years now and used to work for a company parting out computers. I was fired from said job after I had gotten sick and was diagnosed with cancer. The reason for my absence was kidney stones. eBay has done nothing but throw false charges my way (duplicate listings, copyright violation) and has kept tearing down my 250+ part store and taking all of the fees along with it. They just charged me 300 dollars for my fees (at which I have sold hardly anything in the past month due to my account being so heavily restricted) and I have less money than I started. Not to mention the medical bills that I can not pay for (the whole reason for doing this was to raise money to pay for the bills since I was now out of job).

I am now locked out of my account because it is "linked" to my previous employer. They will not allow me to sell anything or do anything until that account is fixed. I do not have any association with that account as it is my previous employer that had fired me due to discriminatory reasons. The kicker: my previous employer is SELLING! They have an online store that is currently running! I have also been hit with nastier buyers as well after eBay took all of our feedback options away and started their insane policies. I have called to try to get this fixed and have emailed and faxed documents DAILY since last week, still nothing. I am so burned out that I just don't know what to do and I have to go in for another surgery in two weeks. eBay, you have ruined my entire experience and taken everything from me for nothing. Thanks also for punishing me and allowing them to sell as I suffer even worse. I even sent in a copy of my legal documentation against the company!

To date, I have received no response from the seller, no item nor refund. PayPal opened a case for 20 days, but then closed it after 20 days with no response from seller either. The transaction appeared on my account as "PayPal Danielle Di" in the amount of $22.99. The transaction no. is 89K5764BC869863D, the eBay item no. is 220729477786 and the PayPal case no. is PP-001-349-268-502. I could not escalate this to a claim because the case was closed the same day I was notified by PayPal. The phone number for the buyer is a fax number because they will not list their telephone. I have sent them emails and tried to communicate with them, but all attempts have failed. At this point, I am asking Consumer Affairs to intercede on my behalf to at least get me a refund. If a dishonest seller defrauds an honest buyer out of money and eBay collect fees from the dishonest seller's transaction, does that sort of make eBay an accessory to fraud? If eBay truly cares about the buyer then why not reimburse what the buyer paid instead of fattening their bank accounts and instituting a biased rating system that is clearly making all sellers look like frauds.

If I deserve a negative and low DSR's, so be it, but I'll be damned if I am going to sit back and do nothing and be rated low for a transaction that allows no defense. If a buyer believes that there may be deception in the description or charges too much for shipping, then why buy it? It has the potential to remove all the proven good sellers because eBay allows them to purchase then complain in the form of a biased rating system. Makes more sense to me that the potential dishonest listing should be reported not purchased unless of course the buyer is a fraud themselves. I'm sure many buyers have been taken by fraudulent and dishonest sellers but I'm not one of them and I don't appreciate being treated like one!

Does eBay profit from Fraudulent transactions? Seems to me that by weeding out the good proven sellers, makes no difference because if they profit from the Fraudulent ones, who needs the good proven ones? I cannot believe that this has not been jumped on by the Ambulance chasers. I guess it will take louder sirens.

I lost top rated seller status and 20% fee discount in spite of being a good proven seller for over 10 years with 23,000 positive feedbacks 99.7% down from 99.9% since the Biased system took over. I have been devastated, not to mention money lost from No fee discount. I worked hard to keep my reputation as a good proven eBay seller and now a handful of complaints with no merit can destroy what I spent years to maintain now with the possibility of suspension while eBay continues to profit from fraudulent transactions.

Their response: "Thank you for contacting us. Honestly, we checked the suit carefully before we ship it to you and we don't find and worn spot on the pants. The black color is normally lightly shiny after used and pressed. However, we are sure that the suit is in excellent condition as we was mentioned with many more years to go. Please understand that the suit that you purchased is not in like new or mint condition that show no sign of previous wear. It's just excellent. So, it may show normal sign of previous wear. Also, We believe that you read all our policy before bid because we state clearly that we don't have return policy. Please let us know if you have farther question."

My response back to them: "Dear boutiquemensclothing, your return policy states: "However, we may make a mistake. If your item has any problems, please contact us. We will resolve all problems fairly." You made a mistake-you said the suit is in excellent condition. The jacket is in excellent condition, but the pants are worn thin and very shiny. It is not in excellent condition. You should have written that it is heavily worn and very shiny."

I then opened a case and explained that I cannot use the pants as they are worn out. The seller then emailed me that I never sent him proof and that "We are eBay suit seller about 9 years. We had many buyers purchased item from us just want to fit on it. If item don't fit or they don't like it, They ask to return for refund. "

The case was decided in favor of the seller with the following comments from eBay: "Based on information provided in the case, the item you received matched the seller's description but you no longer wanted the item. eBay Buyer Protection doesn't cover situations where an item is accurately described." They made this decision without asking me for pictures or if I sent the item back. It would seem that they were buying what the seller told me "We had many buyers purchased item from us just want to fit on it. "

I appealed the decision asking them if they were prophets that they knew that the reason I was asking for a refund was because I just didn't want the item. Their lovely response: "To avoid this frustrating situation in the future, I would encourage you to inspect the listing completely before placing a bid or making a purchase. Bidding is meant to be fun, but remember that each bid you place enters you into a binding contract. It is very important to fully understand the entire listing before committing to buy."

If I had never bought anything on eBay, I would have been able to relate to the above comment; However, I have bought and sold several hundred items on eBay and never filed a case other than one time when an overseas seller didn't deliver the items purchased. I have bought about 15 used suits on eBay and even though they are sometimes in unsatisfactory condition, I never complained to eBay.

It is very insulting for them to take the seller's word for it. It is disgraceful for them to tell me that I should remember that although bidding is meant to be fun I should take it more seriously. I am very surprised and would love to see a class action lawsuit filed against them.

eBay recently added a new listing policy-- the Duplicate Listing. eBay announced on Tuesday that beginning October 26, a new Duplicate Listing policy will be enforced to prevent search results from being dominated by multiple duplicate listings of the same item from the same seller. The item offered in a seller's fixed-price listing must be significantly different in buyer benefit and value from items offered in their other fixed-price listings. In short, sellers may have one fixed-price listing per identical item. Multiples of an item must be sold in a single multi-quantity fixed-price listing.

Sellers who continue to create duplicate listings for identical items may be subject to a range of additional actions including listing cancellation, loss of fees, limits on account privileges, loss of seller status, and account suspension, says Dinesh **, VP of Seller & Buyer Experience. While this new policy sounds great theoretically, eBay does not have enough people to monitor all their listings as well as removing all prohibited listings. Action seems never has been taken against giant sellers. It is unfair to both eBay buyers and sellers.

I have been selling on eBay for quite some years and now, with this DSR (Detail Seller Ratings) which is a secret to the seller and the buyer can rate you anyway they want without an ability of the seller to rebuttal, they are penalizing any seller who gets a low DSR in any category. I was selling 10 items a week and now, because of this restriction, they have been limited to just 10 a month. What caused this was I had some problems with some of my buyers. One buyer purchased 3 items from me at once and the auto-combined shipping was not programmed right and he got hit full charge.

So instead of saying something, which I would have refunded the extra money, he just hit me with 3 bad DSRs on shipping charge. Once it was done, I could not contact the buyer to reverse it. The reason I know who hit me with the low DSRs is because I am a low volume seller and can see a movement when someone hits me with a low rating. Another complained about the shipping charge, so I just sent him an invoice deleting the shipping charge. Of course, I did not list it as free shipping so once again, eBay allowed him to hit me with a low DSR on the shipping charge. Then, there was a buyer who was going to pick up his merchandise. When he got there to pick it up, he chose not to want it. I refunded him the money right away. The next day, he sent me a Paypal invoice for more money (for his time and gas). When I did not give him this money he demanded, he hit me with a negative to include a low shipping cost DSR, even though there was no shipping involved and it was a local pickup.

I believe they have since changed this policy not to allow for DSR ratings on shipping when it concerns local pickup, but yet it does not help me. Ebay allowed it and condoned the behavior. I spoke to a rep and they said it was within eBay's policies to allow buyers to do that and there was nothing they could do. So we know they allow for extortion. But somehow we, as sellers, can live with that by trying our best not to fall into a trap. Also, the percentage of buyers who do this is very small in numbers, so odds are in our favor for the most part. I look at it this way, 1 in 6 years is a good odd. I got hit with another negative from a buyer who wanted to return a damaged item after 45 days in his possession. This included yet another low DSR on my shipping charge.

What I find hypocritical on this one is both eBay and Paypal will not get involve after 45 days of a transaction closing, because too much time had past. But they will allow for extortion, once again, by allowing the buyer to place a negative mark on your selling abilities. Again, no help from eBay. Anyway, my problem is I am in compliance with everything except for my shipping charge DSR. That one is over the limit by 3 and has restricted me from doing further business (except 10 items a month) on the site. According to eBay, I have to wait until the next evaluation period which gets that shipping cost DSR in line. This is 12 months away.

I fulfilled my part of the contract. I placed an order, paid it in full, complied with eBay directives. In return, the seller did not ship the items and could not supply valid tracking information or proof of shipment.

By stalling and paying a fraction of the balance, but calling it 'refund', the seller was supported in this scam by loopholes in eBay policy and inept service representatives. eBay did not fulfill their half of this agreement, which is resolution of issues and buyer protection. There are major loopholes in eBay policy easily exploited by ethically challenged sellers. I’ve lost a considerable amount of money due to eBay's policies and poorly trained personnel, and have dated electronic documentation. Yes, I checked feedback and seller rating before buying, even emailed with a few questions to check out their response. I placed an order; 7 amber items with a company based in Lithuania, which never arrived.

I wrote this 47 days after order "shipped." Seller sent polite emails reassuring the order was en route and again, provided tracking numbers. When I replied a digit might be wrong because I couldn't find any record of them on the USPO site, the seller said he was able to access the documentation, then forwarded the number again along with dates documenting its departure from Lithuania and arrival in the USA along with a link to a Lithuanian carrier's site, but no record there either. Forty-five days later after I opened a dispute, seller sent refund for one necklace at $61.00, and responded to eBay caseworker by saying he'd refunded the payment.

He did this on the night of the 44th day. The eBay case was closed because he said he'd refunded my money and supplied a PayPal Unique Transaction number. Basically, he refunded $61.00 and made a profit of $413.00, because: (1) 45 days had now passed (by the time I received the email, checked the amount at PayPal, and got in touch with a human at eBay) so a new case can't be opened; (2) eBay interprets the partial refund as meaning he'd refunded the entire $474.00, the case was declared resolved and 'could not be reopened' because the decision is final. (3) eBay representatives insist there is no way to refund my money because eBay policy 'does not cover deviations like this'.

The system says deadline has passed, resolution was accomplished by a refund, case closed. They also said that I needed to file a case for every item in a transaction, even though the necklaces were purchased as a 'lot', listed on one PayPal invoice, paid for in one payment, shipped in one box under one tracking number. There is nothing in eBay policy stating that every item in a lot purchase must be entered individually. So I had entered only the first item, thinking that since all items had the same transaction number, all would be included. The eBay representatives seemed unable to comprehend what was going on, even with all correspondence before them.

Seven times in a row, various eBay representatives regurgitated patronizing remarks, instructed me to open a case, then ignored my response that eBay programming software won't allow me to do this. My loss was the direct result of eBay allowing the seller to drag out the process past 45 days by appearing to comply eBay programming that would not allow me to follow their instructions, and their total inability to deal with this glitch. Long wait periods over an hour were common for chat or live conversation.

Some representatives do not listen, but simply repeat instructions. For example, ignoring my comments that I’ve already attempted to do this, but eBay programming wouldn't allow me to reopen or dispute the case. The typical response to this problem was: "Well, then there’s nothing else we can do, sorry. Have a wonderful holiday, Ms. **." As of today, 12/29/10, I’ve put a stop payment to PayPal on my account for the $413.00 and the issue is now in dispute.

But every time, I receive the same answer: "Ebay will get back to you within 48 hours", which of course they never do.

Therefore, I would not suggest anyone using Ebay as they are there just to make their money. They do not care about scams as long as they get their commission. I would love to find a rich sponsor so I could take things much further and sue them for it. Who ever reads this, please pass this message on so the world would know their real reputation!

I sold a pair of earrings on eBay to a seller. I charged a handling fee for the item, in addition to shipping, because it required a special trip to pick up the items. I had to insure the package, and I bought packing materials. The buyer was disgruntled about the amount, despite seeing it when he bid on the item, and contacted me and very rudely demanded that I lower my shipping costs. I decided to be nice and took off $5, but he was not satisfied. He wanted me to send diamonds through the post office, which is not a shipping method I offer. I refused, and he threatened negative feedback (against eBay policy), and threatened to not pay (also against eBay policy).

I told him that if he did not pay I would report him and he paid for the item. I sent the item to him, and he disputed the sale upon receiving it. In his dispute he lied about the cost of shipping and the condition of the item saying that it was used when it was still in the original packaging. He then used another one of my current sales to harass me through email, and threatened me that I should do what he wanted "or else". When I responded to him that I had received his dispute, and would offer him a refund (despite clearly stating that I do not accept returns) minus the cost of original shipping, he called me names and refused.

I escalated the case to eBay to resolve, and asked him to stop contacting me. He replied back that he would not stop contacting me, until I did what he wanted. I stopped responding to his emails, but he kept writing. Eventually, I reported him to eBay via their chat system. After more than two hours, they basically said tough **, and that I would have to appeal the case, if they found in his favor. I filed three separate complaints through their online forms, saying that this man was continuing to harass me via email. I received no response to my harassment complaint, but did receive a response that they had found in the buyers favor, and that they were issuing him a refund.

They gave him my home address. It is completely unsafe to do when a seller has a registered harassment complaint against a buyer! eBay finally got back to me more than a week after my complaints, and gave me a phone number to call them. The person on the phone had no idea what she was talking about, and barely spoke English. She refused to let me speak to a manager. Then, she transferred me to another line, where I waited on hold for literally one hour, before completely giving up.The next day, I had an email response from one of their agents and started to feel hopeful. Until after I replied back, I received another email from them suggesting that I use their chat system to resolve my problem. I have now filed a complaint with the Better Business Bureau.

This ordeal has cost me $16 in shipping, plus the cost of the materials to ship the item, and the time to do so properly. It cost me approximately $3 in PayPal fees (which the buyer imposed on me without my permission), and 3 hours of my time at work talking/waiting on hold for eBay. I also lost the sale of the item which was $50.

When I told eBay about the problem, she said "Your only option is to open a new account with a new email address" which I explained I only have one email address . So I asked if they could reset all my passwords so I could use the site, again she said, "I'm sorry, your only option is to open a new account with a different email address." I contacted eBay's trust and safety.

They said that they took care of it. Now, 2 months later, not only did they not take care of the issue, but they allowed the seller to post his feedback page, my personal and business info. The seller (sharingtimelesstreasures) "Shari" (400 positive feedbacks with a 100% rating) was notified immediately. Shari apologized for the over site and promised to send them right away. 4 days later Shari sent me a message through eBay asking for my address because eBay had accidentally deleted it.

I was expecting the missing pieces to have arrived overnight but apparently the seller was in no hurry. When the power and USB cords did arrive I was appalled! The seller had sent me extremely old, worn and dirty accessories. I guess "MINT Condition" doesn't mean what it used to. I filed a complaint with eBay stating that I had bid, won and paid for items that were not equal to what had been described and offered to send them pictures of the items that the seller had sent.

Without ever contacting me directly, I received a notice that eBay had sided with the seller. Since the phone was a gift I had to go out and purchase replacement parts for $35. To make matters worse the seller is basically trying to bribe me by saying that if I will send the dirty, gross, worn and damaged parts back and leave positive feedback for him/her then they will reimburse me $19 and give me "positive buyer feedack". Uh no thank you! I paid immediately and held up my end of the bargain and evidently eBay could have cared less.

I'm sure if I send the accessories back to the seller then some other unfortunate and unsuspecting buyer will wind up receiving them. I'll eat the $35 bucks just to have the opportunity to tell the eBay world that this seller is a fraud. Maybe he/she has done this same scam/bribe to other buyers and that is how they have managed to get a 100% rating. People change and if this person ever earned their 100% rating then they have compromised their business ethic and eBay is enabling it!

The real ordeal started there. Within the first two hours, the charger started emitting foul smell as if something is burning. I immediately contacted eBay, who turned me to the seller. The seller said that it's the initial insulation which is burning and there is nothing to worry about it.

So I kept using it. In the next two days, nothing happened. On the third day, the charger suddenly made a big noise and stopped working. Smoke started coming out of it. It had burnt internally. So I raised a complaint with eBay for a replacement since it was under warranty and the warranry clearly covered short circuit and burns caused due to it.

The customer care never bothered contacting me to find out the exact reason of what happened. Instead, they contacted the vendor who simply said that it is customer who has misused it; hence, no replacement can be given. The eBay folks closed the complaint and put the blame on me. They later refused even to hear to me. They simply removed the complaint option for my account. This is one really disgusting and useless company.

I submitted the tracking number and the proof of delivery. eBay then denied the refund even though the misrepresented item had been returned to the seller. Lucky for me, I used the American Express Card to pay for this. I have disputed this charge with AX and have every confidence that with the proof of delivery returned to AX, I will get a refund.

I finally got through eBay. eBay would not tell me why they denied the refund and that AX would support their action. I have been a member since 1977 and that is not the AX way. If you dispute the item, send it back and have proof of mailing, AX takes care of their client. Thank God, I always use the American Express card for all payments on PayPal. I am rather surprised that PayPal/eBay would tell people that AX would not treat their clients fairly based on the evidence submitted but just because they are PayPal. Shame on eBay.

The item was not delivered and EBay removed any references to the transaction after 45 days had passed which was before the estimated delivery date. Since then, the seller has bumped out the estimated delivery date another 2 months extending this transaction over a period of more than 4 months.

There is no means to recovery my costs because EBay only allows you to file a dispute within 45 days and no means to flag this seller as a rip off artist because the 45 days has passed so, if you want to rip people off on EBay with no accountability, simply put an expected delivery timeframe outside of 45 days and there is nothing EBay will do to stop you. They sponsor these rip off artists all the time with no means for the seller to file a complaint or leave feedback. EBay will not help you. PayPal will not help you. We are selling on eBay for over 7 years as **. We are a top power-seller with over 15.000 perfect feedback. We are selling rare gemstones and never had any problems. We ship all our items with registered airmail and they usually arrive very quickly. Most of our buyers are in the USA. In October, a woman purchased 14 items from us with a value of almost $700. She contacted us some time later, saying the parcel has not arrived. We forwarded her the registration number which in some cases, but not all, is used in the US postal system as tracking number. After one month we started an official post office investigation to track down the parcel. We could already confirm that it was on a flight from Bangkok to the USA and arrived in New York. We could not track it further as the post office said they need time as it is a manual process to track it down.

The customer opened an eBay claim, saying the tracking number we sent her was fake and we are a fraud seller. eBay, without contacting us, without looking at the proof of shipment and the post office investigation refunded the seller and then threatened us to reimburse them now (almost $700) or they will suspend our account. We had informed our eBay account supervisor, who gave us right, that we indeed have sent the parcel (he had checked himself with Thai post office). He had informed the management; still, there was nothing he could do. He told us even if he knows it is not our fault, we should accept the loss of the parcel, pay eBay the reimbursement fees and in future send it maybe with another shipping method!

We have appealed the process with eBay and eBay promised to get back with us within 24 to 48 hours, but they did not care. We tried to contact eBay on the live help chat, but there they stopped even giving answers. Moreover, eBay recorded now on our account 14 violations, so that we are loosing the 20% seller discount for outstanding service. We pay every month $1500 in eBay fees. I had contacted a person who is post man at the US post office. He told me (I have the chat protocol) that since January in the US registered parcels from abroad are not treated anymore as registered parcels, meaning they can be delivered without having received a signature. We very much think that this is the case. We have all emails on file, the answer from our eBay top supervisor, the chat protocol, where eBay refused to give us an answer, all proof that we had sent the parcel, and proof we started a post office investigation. eBay doesn't care. They told us:

“I know that this is not your fault, but this is also not buyer's fault that he didn't receive the item. As for eBay, we are only doing this to protect buyer's interest since buyer purchased this item since October. My another suggestion is if the shipping service is not very reliable, you might want to try using other shipping providers/services, at least for more expensive items.

Top seller account manager Afre, 7 years on eBay, a top gold power-seller with 15.000 perfect feedback, and paying monthly $1500 in fees—this is how eBay is treating a customer? Where is the justice? We decided we will not pay eBay the $700 of the refund they have given to the customer, will inform the press, will not pay our eBay fees this month and we will let eBay suspend our account. We live in Thailand and it is already very difficult for us to make a living. eBay sales have dropped a lot the last year, even if we have better and cheaper products.$700 is a lot of money for us. It is the salary of 3 staff. We cannot afford it to just lose the money and the stones, having to pay as punishment every month $300 more as we lost our 20 % discount. eBay wants us to refund the money or suspend our account. We are a small company and we all live from it; thus eBay is endangering our existence. eBay admits it's not our fault but they still punish us with taking away 20% fee discount, which is $300 a month. Can you help us?

I sold an item on eBay for $210. It was an electronic VoIP item that I accepted a buy-it-now price for and I got paid for it. I was very surprised to see that the buyer paid $210.00 for my VoIP electronic device, but I only got $203.61. Then I found out about PayPal fees, which put me at the very highest fee scale which is $0.30 (excessive of course!) plus another 2.9% of the the transfer! It is insane to think that a company as reputable as PayPal would have such outrageous fees, which come on top of the eBay fees, which is another bunch too that I don't know yet. So far, I've paid eBay $0.30 cents for having two additional pictures of my item when I listed it. It was great at first to believe that I saved a bunch of money on fees as I was supposedly taking advantage of a "limited time offer" of eBay that says that I will pay no fees for my listing, when I'm actually losing money thanks to eBay and PayPal's excessive and outrageous fees!

And what happens when you try to contact their legal department to file a formal complaint about their ridiculous fees? Nothing, absolutely nothing because nobody has any way of reaching the giant's (I'm referring to eBay) legal department, which I'm sure they have one, if they didn't, they wouldn't be able to get away with ripping people off legally by charging fees for every little thing. I can live with paying a few cents to eBay for listing my item and letting me keep the fair remuneration for my work of selling it on their site, that part is fair, what is not fair is that eBay and PayPal have only one owner and that owner is keeping an average of 11% of the money that is used on every eBay transaction, which when you add it up, turns out to be millions a day. That is definitely not fair because buyers and sellers are the ones keeping eBay alive and all we're getting is a shut door when we try to file a complaint.

Obviously, the fees are not negotiable and taken out automatically by PayPal, which in turns it's the same eBay. I hope our voices can be heard somewhere and I hope there's something we can do to have eBay lower their humongous profits and give us sellers and buyers a break. I've only sold two items on eBay and I'm regretting every time I did as I got taken by eBay and PayPal twice already. I wish we had a good competitor to eBay with reasonable fees so I can post my items there instead of making eBay's pockets fatter.

They are after the almighty dollar, over and above fairness to buyers, so I just feel everyone should expose them, and others learn and stop supporting these crimes.

I requested for my money back. The seller said no shipping charges would be refunded on his sales page. Realizing this and the audacity of this fraudulent sale/auction, I filed a complaint with eBay, and later followed up and sent eBay a copy of my shipping/request for all costs email to seller Airflow14200.

My email to the seller said that, "the Item was shipped from Postnet today, shipped via USPS Priority, with tracking number 9101969010386700077275. The shipping costs were $9.76. eBay doesn't allow me to send you a copy of the receipt. Please let me know how I can get a copy of it to you. I am asking that all shipping, to and from you, be returned to me as well. When the wrong item is sent, or an item is not as described, inducing higher bids, it is wrong and unfair to charge the buyer/customer any fees. That would make the buyer/customer a victim.

Please return all my costs relating to this faulty sale". I received no response to this email from the seller, and upon receipt of tracking delivery information by eBay, they sent me an email saying, "thanks for shipping your item back to the seller. According to tracking information, the item you returned has been delivered. The seller will send you a full refund of $79.95 by Nov 18, 2010. The refund includes the purchase price plus original shipping. When you receive your refund, please close this case in the Resolution Center. You can view the details of this case in the Resolution Center".

eBay does not acknowledge my email or discussion regarding my loss, in return ofmy shipping cost loss, and lacks concern any kind fo this type of fraud, and loss to customers on their auction site. Why would they? If Ebay loses the criminal seller, how are they going to make their percentage of any of their criminal sales? There was no reprimand for these fraudulent actions and sale. This seller, Airflow142000, has not had interrupted service on eBay of any kind or length, or any other reprimand for this so very clear fraud! He is free to turn around, and try to sell the returned garbage to someone else now.

eBay is just as big of a criminal, as the fraudulent sellers they support, when they do not ensure their buyers' safety, and refuse to properly handle fraudulent sellers. How fair is it to fraudulently lead someone into believing they are buying a product, by falsifying information to induce your bid or purchase, not produce the item, and then leave you holding a loss for return shipping in any amount? It adds up! Okay, so I am an idiot for using eBay, but you don't have to be. Here is why I am. This is not the first time this has happened to me. I used to purchase gemstones through eBay. Many came to be, and tested out as glass, or something other than what they were described, which descriptions are made to induce higher bids, like claiming a fluorite gemstone was Paraiba Tourmaline.

The bids are hundreds of dollars in difference to value, and shipping is $10.00 to $18.00 to return a gemstone overseas, where most gemstones come from. I have closed my eBay account before for two years, because of this constant loss in shipping, until I recently received an email from eBay stating that they will guarantee shipping costs will be returned in future orders. The wording was just enough to get you sparked up, or believing them, a manipulation of words to reel you in, but omitting that they will only get shipping paid to the seller returned, and did not detail that your return shipping costs will not be requested or required to be returned by the seller.

I hope these complaints get out, and people take heed. If we, as consumers, use these fraudulent companies, they succeed and we continue to fail more, and more, and more. If we wake up, put our foot down, stop using eBay and other fraudulent Internet selling sites, until they work to earn their income, protect the buyers and sellers properly, they will have to change their dirty methods. This is my last eBay adventure ever. They cannot be trusted over their greed and manipulative emails. This was a $9.76 loss (providing I really get my money back from the seller), but aside from this, in the past, I have lost approximately $370.00 in return shipping costs in several fraudulent sales on eBay. When I realized that, I stopped using them. I am an idiot for believing in them, and that lousy email of theirs. Fraudulent sellers should instantly be banned, stopped, and prevented from continuing. What is eBay thinking? Of that almighty dollar? Guess what, it is yours. They essentially help these fraudulent sellers steal it from you, and they are okay with that. Are you?

If a problem arose, we were able to figure something out to fix it quickly. This time, I sold a Nintendo Wii package to a customer in Miami. Now I have sold gaming systems before and never shipped with tracking and every one of them showed up without a problem. Evidently, this package never reached this customer. We emailed back and forth during the wait and it still never showed. I again did not use tracking, but did take out insurance. The customer eventually requested a refund, which I refused. I would be out that money and out the item; because I had proof of shipping, I fulfilled my agreement. She opened up a case with eBay.

eBay alerted me to the open case and asked me to respond. I did so, telling them the story and explained I had proof of shipment and proof of insurance. Without even asking any question nor requesting the proof, they refunded the customer. I had already withdrawn the money from PayPal so it resulted in a negative balance. I called a supervisor and again, they ruled in favor of the buyer. Now I had proof of shipment and this customer had no proof that the package didn't reach her. I have now read that eBay regularly screws sellers over, always supporting the buyer. What do they care? They got their fees out of you so giving back your share isn't a problem for them. Now I'll be losing my eBay account and PayPal account that I have had for 10 years because of this one incident. Sellers mean nothing but a means to get money to eBay.

I was asking, at the time, for a replacement set of good wheels or a full refund. The rims, although used, were described by the seller as "Like new, 9.7 on a scale from 1 to 10". The following is an exact quote from the sellers description: "These have been inspected by a professional on a wheel balancer, have been found to be straight and true, with no bends or cracks, other than minor scratches as shown on the pictures."

Obviously, there is a major difference between the described condition and the true usability of the rims. The seller either deliberately lied or was intentionally misled by an employee. It is not possible for the rims to have been damaged in shipping or by the tire shop without noticeable scarring or damage to the rim. Only being 'curbed' or other damage while installed on a vehicle could cause such bending. On 30 Oct, I appealed the decision by eBay's 'Customer Support', but never received a reply other than the form message that said they would contact me with a decision in 48 to 72 hours.

Ebay's Buyer Protection is worthless if the seller is not honest. I bid on an item listed as "fully functional" but the seller ** also said that she did not have the means to test it and see if it was working. It arrived without parts inside. Ebay's resolution center decided that she was not liable for it being fully functional, despite that listing, because she had said she could not test it. Then, she emailed me saying to return it for a refund but after I sent it back, she appealed it--I am out the cost of return shipping too. Ebay only works if folks are honest and it is dishonest of Ebay to proudly portray itself as having any real buyer protection when it does not protect you from dishonest sellers.

I sold a PDA (pocket computer) to a buyer in Russia on 10/1/2010. The buyer used "buy it now" & chose USPS International Priority Mail. The delivery estimate for shipping to Russia (provided by eBay) was 11/26 - 12/01. On 10/3, I delivered the item to my local post office. I then provided the buyer with a tracking number for the item. There was no further contact from the buyer, until 11/05 when he sent me a message asking "where is my item?". Before I could even reply to his message, he filed a complaint against me & initiated a case in eBay's Resolution Center requesting a full refund.

I checked the item's tracking number & it showed that the item left the US on 10/7 & was currently in transit to its destination in Russia. More than a month had passed, which seems a little long, but I guess shipping something to Russia can take a long time. So I double-checked the "delivery estimate" that eBay provided to the buyer & at the time the item was sold, it was 11/26 - 12/01.

So I told the buyer to check the tracking number, & to look at the delivery estimate. It was only 11/06 so there were still 3 weeks left until the delivery could be considered late & be eligible for a refund, according to eBay's "Buyer Protection Program. " I also told the buyer that I would contact USPS by phone just to make sure there were no problems.

The USPS representative I spoke with said there was no problem, & that it's quite common for a package going to Russia to take 2 months or more. I explained all of this to the buyer. I sent 3 responses to him in the Resolution Center. The buyer never responded to me since he initiated the case. The whole point of opening a case in the Resolution Center is to provide a format in which buyer & seller communicate with each other in order to resolve any problems with a purchase.

After receiving no response from the buyer, I "escalated" the case to eBay customer support. By doing that, I gave eBay permission to review my case & make a judgement in favor or me or the buyer. I explained my case clearly, & pointed out that I wasn't at fault. I didn't violate any part of the rules contained in eBay's "Buyer Protection Program". The delivery estimate wouldn't expire for another 3 weeks, so I wasn't obligated to refund the buyer's payment at that time. If I would have refunded his money at that time, it was still possible that he would receive the item within the following 3 weeks.

It seemed like a clear-cut case to me. So after thoroughly explaining my case, I submitted my request to escalate the case to eBay customer support for them to review & make a judgement. 30 minutes after I submitted the request, I received a judgement from eBay. The judgement was in favor of the buyer, & $174 was immediately withdrawn from my bank account. I was quite shocked, so I immediately appealed this decision. I explained the case again, & begged them to please review the case again, & more thoroughly. Being frustrated, I decided to call eBay customer support to explain my case & to be able to deal with a representative from eBay. So I called their customer support number with the PIN# provided for my case. The PIN# is provided to ensure that I would speak to a representative quickly.

I was placed on hold for an estimated time of 5 minutes. 65 minutes later, I was finally able to speak to a human. He identified himself as Michael. He wouldn't provide any other information, such as his last name, extension, employee ID number, position at eBay, etc. He was the most rude gentleman I've ever dealt with. When he first started speaking, he admitted that he hadn't had time to review my appeal yet. So I explained my case verbally & when I finished, I asked him how it was possible that the judgement was made against me, since I didn't seem to be violating any eBay terms & conditions or any part of the eBay Buyer Protection Program.

His only response was that "it's taken way too long for the item to be delivered" even though eBay's own delivery estimate wouldn't expire for 3 more weeks! I repeated the delivery estimate numerous times to him, & his reply was "it's been too long already" & "you should've used a faster shipping method". The buyer was aware that I was using USPS International Priority Mail before he purchased the item from me; he agreed to that shipping method when he purchased the item. "Michael" refused to explain any further why/how he made a judgement in favor of the buyer in my case. He refused to respond to any of my inquiries & requests for an explanation. He threatened to disconnect my call after every question I asked him.

I asked to speak to his supervisor or anyone else that could be of any more help to me. He refused. Then after a few more attempts from me to reason with him, he disconnected the call. I have 377 sales on eBay with 100% positive feedback, & I've been a member since 2002, but I was treated like a thief & had the phone hung up in my face. It seems that eBay's Buyer Protection Program doesn't provide any protection or rights to the seller. It also seems like eBay doesn't even follow their own rules contained in that Protection Program. So now I've lost $174 & a lucky buyer in Russia will probably receive the item for free before the eBay delivery estimate expires 3 weeks from now. It's unacceptable to me, but it seems like I have no recourse.

We sold a sell phone on eBay and the phone was in perfect condition as described. I provided the documentation that proved the phone did work as described. My son had only used the phone for about two months. The phone needed a repair and we had purchased an extended warranty to repair it. While the phone was being repaired, my son purchased a different phone and decided to sell his old phone when the item returned from "Square Trade." The phone had a brand new LCD put on it for which I have the paperwork and was call tested for three days before "Square Trade" sent it back. It was a virtually brand new phone. We listed it on eBay and the buyer who purchased it said the phone could not be activated.

I called the carrier, Verizon and they said there should be no problem activating the phone. I relayed this to the buyer and told her to try again. She contacted me again to tell me the phone could not be activated. I called Verizon again and discovered that she had activated the phone. When I informed her that Verizon had told me she indeed had activated the phone she then changed her reason for wanting a refund to say the phone did not work. The buyer contacted eBay and asked for a refund so eBay froze our PayPal account and ruled in favor of the buyer.

When we received the phone back, it was in perfect working order, as described. In the listing, we included that we would not accept refunds since cell phones can be part of scams. The buyer had 0 feedback with eBay and we have nine years buying and selling with eBay with perfect feedback. We lost time and shipping costs because of eBay's decision. How can eBay freeze your account? We completed our obligations and sold a phone as described just as we have been doing on eBay for nine years. We feel that eBay's decision to rule in favor of a 0 buyer who misrepresented their reason for a refund at our expense is completely wrong and we should be compensated for their error.

You now require that you have unlimited access to my bank account through Paypal. This will not do. You cannot have unlimited access to my personal funds; that is stupid and I will never agree to that. If you would like me to sell on eBay ever again, you need to change this. As you must be aware if you don't okay automatic payment, my items are rejected and will not upload. It's hard enough already to use eBay for selling. It just gets hard and harder every year and the more we complain the less eBay cares.

So many people we know will never use eBay because of these dumb rules for sellers. You know that turbo lister tells you how much to charge for shipping and the price often time is less than it actually costs! What about not having enough to cover shipping? This in turn makes it impossible to list these items at all. It's about time you sent my concern's to John Donahue, the president of eBay and not responded from what your screen tells you to say (copy and paste). Please don't send me a prepared answer, I am so sick of them. This is what happened to my account automatically: status cancelled on Oct 31, 2010; Bill term initiated date Oct 31, 2010; Billing limit $300,000.00 USD (per month) billing limit three hundred thousand dollars. I had written to eBay customer support to engage in mediation in the matter, since the buyer was new to ebay and clearly did not understand the consequences of leaving negative feedback. After evidence which I have, that demonstrates a trend of improving feedbacks and seller performance, eBay sent me a message indicating that my account has been indefinitely suspended.

I emailed eBay to explain the circumstances and ask for human intervention, since the majority of the "monitoring" is performed by their computers that do not take into account legitimate reasons or circumstances of these types of matters. I have received no response. I was sent a generic response at the time my account was shut down, with no prior notice; nor is there anyone I can contact to speak with. After several hours I became suspicions of the identity of the person that made the accusation, Captain Eduardo ** of the Peruvian National Police.

I was supplied with a phone number and an email address of this captain. The phone number was a non working number in Lima Peru and the email address had a domain name with Google. The senior counsel of the embassy discovered through records there was never a person of this name in the force, and there was no investigation concerning this matter. Michael was informed of this information but refused to allow me access to my store. Many attempts were made with the eBay CS to no avail. Eventually, I had to pay $5,000 to have my case heard by an arbitrator in Chicago and the arbitrator ruled eBay could do as they pleased because of the user agreement in place.

However, the arbitrator did not allow for employee misconduct that has taken place. Michael error when he accepted information from this spoof email as factual, which is a violation of eBay’s policy. I won and purchased an item that was listed as new with tags. However, when I received it, the handbag had this overpowering stench of cheap perfume. Not only did the handbag stunk of cheap perfume outside the handbag, the inside of the handbag smelled just as bad. It appeared the seller was trying to coverup another smell (maybe a cigarette smell), but it stunk up my whole room.

As I continued to inspect the handbag, I noticed that the handbag had no tags (as seller posted at auction time). I also notice that the gold plating on the handles were wearing off (indicating that the handbag was not new). Another indication that the handbag was not new was there was a tear at the end of one of the leather straps (after a few uses the leather strap would break off). This handbag was used not new.

I sent a message to the seller about my disappointment of having purchased a used and smelly handbag. She did not reply and she indicated before the final of the auction that she did not accept returns. Well, I filed a complaint with eBay against this seller. Not only did this seller intentionally post a used item as new w/tags, she used a fake account to up the price (I did a little investigating and won't go into details about how I discovered she was using a fake account to increase the price).

Anyway, eBay informed me that the found the seller guilty and seller informed eBay she would refund all my money. Well, I sent back the package using signature confirmation (costing me $7.70 of my own personal money to return an item that was deceitfully posted). The seller received and signed for the package but she has failed to refund my money. I have sent numerous emails to eBay but they have ignored my complaints. I also spent over 3 hours waiting to get through eBay Customer Service via telephone. When I did finally get through, Customer Service said that I needed to contact the resolution center customer service via e-mail!

Can you believe that? I did what she said but my e-mails have been ignored and not returned. What I can't fathom is that eBay is advertising on their website about the buying protection that they offer all eBay buyers! Liars! Since I was not getting any results from eBay, I decided to file a complaint with PayPal. Well, PayPal cancelled my complaint due to the fact that my complaint against this seller is still open with eBay. I was livid! I emphasized to PayPal that I was not getting any response from eBay about a resolution to getting my refund. Do you think PayPal cared? Of course not!

eBay owns PayPal, so why should they go out of their way to assist me? Now this evil seller has my hard earned money and the used and smelly handbag that I sent bag. Just a note: Beware of seller Natalia2858. She is evil, mentally unstable, a liar, deceptive and unscrupulous. This evil witch is money hungry so don't buy from her!

As for eBay, I'll find a way to get my money back. I plan to go to the Federal Trade Commission to file a complaint against eBay and PayPal. My advice to everyone: Don't buy from eBay. eBay offers nothing but false promises. Also, they have the worst Customer Service that I have ever dealt with. I would love to see eBay fall off the face of this planet. The day eBay fails, I will be a day of celebration for all those who were ** by eBay and it's evil sellers.

There is a major breach of security.

After I sign on from eBay to PayPal to pay for an item, after payment I am on an eBay page. However, if I pull up PayPal it takes me to my list of payments made/received - signed into PayPal. The PayPal door needs to be logged off and secured after payment is made. I can't believe EBay and PayPal are not aware of this breach in security. Now it is 11 in queue with 14 minutes to go, but I am still submitting this. If they are so busy it takes over an hour to get to a customer service person, I highly doubt this major item would go anywhere. Maybe they will pay attention through this avenue.

They must be made aware of this. This isn't the first time I am identified this problem. It did the same thing a few weeks ago. I also tried calling in - got the same thing - would be over an hour wait. And since eBay owns PayPal, it doesn't make sense to call PayPal instead of eBay. Sorry eBay, I had to get this message out, and figured this would be the fastest and most effective way of doing so since I cannot get through to you in a reasonable amount of time. I tried the phone and was on hold for 47 minutes before hanging. Even if I got the $20, it would have been eaten up with cell phone minute charges. eBay has absolutely no customer service. I will never again try to take advantage of one of their bogus offers and am strongly considering switching totally to Amazon.com, where at least you can send an email regarding a complaint and get a response. They wanted the details of my bank account. I refused and was told, after several emails, that I was a questionable purchaser. My rating at eBay was 100%. I canceled the credit card that was registered at PayPal and yet PayPal will not let me close my account because the credit card is involved in a transaction! What the ** is going on? I posted an iPad and a cellphone on eBay.The iPad sold for $740 and the phone for $530. Another bidder was upset and put $740 in to my PayPal account and I returned his funds. He then he posted it again and I called eBay and PayPal on three way. I thought it was taken care of.

I shipped the phone and the iPad. PayPal held my funds until every one got their item. eBay took $399 out of my bank account because they counted the bidders that won and did not pay with the bidders that did win as well as the bidder that was refunded. The bidder that won the phone put in a dispute three weeks after she got her phone and PayPal refunded her saying buyers have 45 days to return an item. Now that is crazy. Then they put my funds on hold for 180 days. Then the person who never even won anything that transaction was canceled and they sent him $680 out of my account. It’s like I just gave away an iPad. eBay took $399. Between the two buyers, she got $530. He got $680. I got $165. Stuck in PayPal. I gave a buyer an iPad for free. I lost a lot of money because they do not want to hear the seller say anything.

When I emailed about this, they rudely addressed the letter to the person who is suspended, insinuating I am lying about who I am even though I have had my account much longer than my roommates. eBay says they will "consider" reinstating my account once the blamed party pays up. I guess they expect the consumers to be their personal collection agents. These policies of theirs must be stopped.

Here is the description of the seller of the guitar my son bought on EBay, Taylor 2001 314-CE LTD. Made in the USA. Rare! With Taylor embossed hard shell case. Madagascar rosewood, ebony fingerboard, mother of pearl ltd edition inlays. Amazing sounding and looking guitar. It has that beautiful bell like sound and great sustain Taylors are famous for. But something extra in the sound I just can’t explain, but it’s wonderful! I have never seen one like it. Comes with the Fishman electronic system, which most players prefer. Comes from a smoke free, pet free studio. Never gigged with, just used for recording. Extremely light nicks and scratches, but nothing that would show up on camera. The case alone is now worth about $200. Comes with key and Taylor truss rod tool. No reserve. Notice the light nicks and scratches.

I paid $1100 bucks and the thing came with a 2 inch long gouge/crack in the top and with the trim coming off the neck by the nut. EBay refused appeal to their so called buyer protection plan which is really a big seller protection plan - now we as honest people have to have the thing fixed and then advertise it giving the truth - why not just keep it? Because this 'sweetest sounding guitar in the world aside from being cracked sounds terrible compared even to a cheaper model made by the same manufacturer.

A bid was placed on an item on eBay. eBay shows the top $ amount the bidder is willing to pay for the item. Ten seconds before the item ended, someone placed a bid just under my top bid which drove my winning price up. eBay tells all bidders they must bid not less than my top dollar amount. But this was not a serious bid as the bidder could plainly see that he did not enter the minimum amount eBay called for. He/she had no chance of winning only the opportunity to ensure that I would have to pay more for the item.

There is nothing to keep the seller from doing this to drive the amount of the money he receives up. He can see that by bidding less than eBay says he must to meet my max. bid (which he can see). He is assured that he can force me to pay more for the item. This seems unethical and should be illegal. eBay should not have accepted that bid as it was seriously under the amount they dictated the bid had to be to beat what I was willing to pay. Transaction took place Tuesday evening, 9/21/10.

The very last option is "Good Til Cancelled" or "GTC" The good till cancelled shows the fee of 0.50 to list the item. That is what I used. Two months later, I noticed eBay was charging me over again every month for the listing I was told I only had to pay a one time 0.50 fee. Nowhere in the listing process does eBay inform you of having to pay any more money. The money eBay charged was automatically deducted from my account without my consent. I sold an item on eBay back in April of 2009. I was charged the usual seller's fee of $34. I paid the fee using a debit card that I had registered online. Months later, I began to get calls from GE money about an exorbitant bill on my PayPal credit card; I had never activated a PayPal credit card. PayPal claimed I owed hundreds in debt for a charge from eBay. It took four hours on the phone between PayPal and eBay, being passed from one customer service rep. to another, before it was established that this was, in fact, an act of fraud. Ebay charged a card that I never activated.

I settled the charge with eBay again, over the phone, giving them my debit card number. PayPal filed the other charge as fraud and I canceled the card (that never should have existed in the first place). Two months later, in Sept, 2010, I begin to get calls from a strange number that keeps hanging up on me. I finally called the number back to find it is a collection agency; they never left a message or even attempted to let the phone ring long enough for me to get it. They claimed they were collecting $34 for eBay.

This is now the third time I am asked for this money. I was enraged! This was also the second time a debt collector had threatened my credit. In the meantime, I am in the middle of purchasing a home, and eBay is messing up my credit standing, keeping me out of a home!

I just gave the new collector my bank information again. I am very concerned that this is an attempt to completely rob me of my money.Of course, eBay is nowhere to be found in this. You can't effectively call or email them because they'll pass you to every customer service person in the world, then refuse to actually fix your problem.

I have a strong feeling that my credit will again be attacked for this same $34. I don't know why they have targeted me, but it is infuriating and has seriously hurt my ability to purchase a home. The constant attacks on my credit have kept me from getting an appropriate mortgage and purchasing my new home.

Ebay's new standards of selling are highly unfair and unethical by any business standards. Their DSR rating system needs some severe adjustments. I've been a full time eBay seller for 15 years. Their new policies are medieval. If for any reason, any of your seller requirements (their rating system is based upon buyers determination) fall below a 2% level (mine is 2.03%), eBay's new policies limit the amount of items you can sell per week, and the amount of income you can earn.

They have just limited me to earning $542. per week, based upon a 12-month review. What does this mean? It means that out of 1577 transactions, 32 people felt I shipped their item out too slow. In other words, in eBay's mind if you get below a 98% on your test in school, you fail. They are penalizing me, by saying that I can only list 75% of what I've been listing. Understand too, that my typical eBay selling drops drastically in the spring and summer months, when I do lots of outdoor selling and eBay is slow. They're doing this to me just before the holiday season? Why would they activate a new policy like this just before the holiday season? What are their true motivations? If my selling limitation is not lifted within the next month, it will create severe financial hardship. My monthly bills currently outweigh their financial limitations put on my earnings. Saying that operating at a 98% level is a failure, is flawed. They need to be stopped.

So basically unless you are willing to let PayPal ***** you, you can't use eBay for anything. So my first and last experience with eBay was a disaster and I'll certainly recommend that everyone I know and interact with stay well clear of this site, no matter how popular it might seem. Procedurally eBay establishes the auction window such as payment option bases, e.g., Credit cards. PayPal or other. Generally the Or Other, is by the seller where he states up front the payment device, or preference. I have concluded about 150 transactions using PayPal. However, starting last year, after I've chosen PayPal, a new window appears occasionally, in which I must engage an imposed process by a second party. Since, these instances did not conform to the regular eBay process, I entered complaint with the seller and usually it was agreed that a money would be okay, or eBay cancelled the transactions.

Last week, 9/2/10, I won the auction and committed to pay to the seller's preference. PayPal Now begins the nightmare. As I was a proceeding with the normal format. Suddenly the format changed, and finding myself with a secondary party. Last week, the 2nd party was Channel Adviser and introducing additional terms, one to plant cookies in order to track my purchases preferences. I communicated with the seller and eBay that I would not follow the imposed procedure.

One of eBay's standing instructions is to report new parties and to withhold payment. But this time eBay was silent about the new party, and instructing me to pay and followed by a daily demand for payment by Channel Adviser. I offered payment by money order or outside payment using a cash transfer via PayPal.

I Googled if Channel Advisor had a connection with eBay and it popped up with an actual window. I concluded that Channel Adviser is a silent partner and a new revenue scheme for eBay, tracking buyers outside purchases. When I had a business student's introduction to the law of contracts, the action becomes void when the rules are changed. I am 2 months away from 80, and have a solid credit history. There were several communications from Andre ** asking when and how the amp would be shipped, and one letter dated August 12th, asking if the amp could be hooked up to his three way speakers. I spoke to the buyer by phone on the 13th of August at 3:23 P.M. I advised him that the amp had been shipped via parcel post.

On the 24th Andre ** had not received the amp, and he demanded a refund. I reminded him that I had shipped the amp on the 13th, within the time frame my eBay page outlines. I provided him with a tracking number and information from the post office indicating that package was still in transit. I communicated that I was surprised that delivery was taking so long, but clearly it was out of my hands. Andre ** wrote back that he did not want the amp, and that if he received it he would return it to me. In spite of being able to see from the post office tracking information that the package had been shipped on the 13th, he insisted that I was not telling the truth.

Andre **opened a case with the eBay Resolution Center on the 24th; Case # **. The Resolution Center urged me to respond by August 31st. The next day, without allowing me time to respond to the case, eBay issued a refund to Andre **for the amount of $62.95. If a resolution representative had reviewed the communications between Andre ** and me, they would have seen that the amp was in transit, and that any delay in receipt was not caused by me. The amp was delivered to the customer on the 27th of August. Because of eBay’s rapid refund to Andre **, in spite of evidence that the order was in transit and due for delivery within a short time, my PayPal account was debited for $65.08. A fee of $2.13 cents was charged. I have not seen a fee for this type of transaction in the past.

In summary: Andre ** is now in possession of the amp he ordered, as well as a full refund. I, on the other hand, have no amp and $65.08 less in my PayPal account. EBay’s decision to side with the buyer and completely disregard my rights as a seller indicates a low level of professionalism. It is inconceivable to me that eBay would refund money to Andre ** without closely examining the details of the case, and without first insuring that my amp was returned to me. This is a clear of case of a buyer changing his mind after an auction. EBay’s actions indicate that they are willing to side with fickle buyers, and unwilling to support their sellers. The eBay commitment to good service should not be one sided. I want my merchandise returned to me in the condition in which it was shipped, and the amount of $65.08 credited to my PayPal account.

eBay has increased what sellers can't do, and what they are requiring sellers to do constantly, they also can now hold or take money out of your Paypal account to give back to a buyer if the buyer files a complaint. We have a buyer who bought an antique clock over a month ago. She now wants to return it because it ticks too loud, even though it has been doing this since she received it and this is normal for the clock. The clearly stated return policy says 7 days after receipt they must contact us & then we have to receive it within 10 days in the same condition as it was listed.

eBay says she can return whenever she wants to & then still leave us bad feedback after we take it back! eBay is breaking its contracts with the sellers & reinforcing fraud and possibly money laundering. This needs to be put to a stop. We had items returned which weren't even close to what we sent, but there wasn't any recourse for us. This transaction is just one of many on eBay and it will cost us at least $123.00 plus the shipping. One interesting thing to note, the buyer's address was in Boston, Massachusetts, but when confirmed, the phone number for her that ebay gave us to contact her was in Connecticut!

I have been a loyal eBay seller/buyer since eBay first started. Now, I'm having trouble with just about every other sale I have. First, it started with a buyer claiming he didn't receive a hat I shipped him. eBay refunded his money out of my account. Then, I got an email from the buyer saying he liked the hat (the one he claimed he didn't receive). So, the buyer had the hat and his money back. Then, I shipped a large box with many Breyer horses in it. USPS said it would take about 10 days for the box to arrive as it was sent First Class.

Well, I emailed the buyer and told her the box was shipped and how long the USPS said it would take for her to receive it. Two days later, she left me a negative feedback saying I was a thief and stole her money and lied about shipping the horses. She filed a complaint with eBay and they found in her favor after a while. Well, I put the tracking number in the USPS tracking and there it was, day and time that the box was delivered. I was on the phone with eBay several times. I finally got someone with some brains who agreed that the box was received by the buyer, and I was refunded my money back.

Less than a month after that, I sold a phone and the seller sent me an email claiming the phone was damaged and didn't work (I was using it right up until the day before I shipped it out). She wanted her money back. I was on a plane from VA to CA at the time she sent the email. By the time I arrived in CA, she had already filed a complaint saying the item didn't work and that she sent me an email and I didn't respond. I told her and eBay that the phone was insured and that the buyer should file a claim with the USPS. The buyer had already started the claim process on line. I faxed her the copies of the insurance receipt.

eBay found for the buyer and held over $300 out of my account. They told me the seller is the person who is supposed to put the claim in and that the buyer had to ship the phone back to me. They told me I was to refund the money within three days of receiving the phone. I spoke with the USPS and was told a claim had already been put in for that receipt and that they issued a refund already. They also told me that the person receiving a damaged item is the person to put in the claim.

They do not want the damaged item shipped back to the shipper. They also told me they were having problems with claims because eBay was giving people the wrong info on filing insurance claims. It has been over a month now and I still do not have my money that eBay is holding. And I still have no phone. The reason being is that when you file a claim with the USPS, you have to turn the damaged item over to them. So, the buyer has her money from the USPS claim. The USPS has the phone and eBay has my money. Within this same time I was dealing with this with eBay, I had a claim against me filed on PayPal (owned by eBay) by a lady who claimed she didn't receive an item I shipped to her. I have it in all my auctions that I only ship to the US.

Well, this lady from Germany was the high bidder on my item, and I found this out after the auction ended. She emailed to ask what shipping would be to Germany. I told her I do not ship out of the US. She said she was willing to pay whatever the shipping was. So, I looked it up and the cheapest to Germany was $13 for a small envelope. I told her and she paid me through PayPal. I shipped the item through the USPS. I was told there was no delivery confirmation outside of the US, but that the customs number on the receipt could be tracked. But it wasn't always 100% once it left the US.

I shipped the item and held onto the receipt. So, when the claim was filed with PayPal, I went to the USPS site and put in the customs number. It showed the item was in NY and on its way. I sent this information to PayPal and the buyer. Even though it showed just where the item was, and that it was in transit, PayPal held the money from my account. I called and asked them why they were holding my money. I was told because the buyer put in a claim, that I couldn't get my money until I could prove the item was delivered. I received two different emails from the buyer on two different days telling me she received the item. These went through PayPal’s claim process site. Still, my money was being held.

After three calls to PayPal, they finally released my money. Now the real kicker and why I will no longer use PayPal or eBay or recommend them to anyone is that eBay got a hold of my debit card number from a purchase I made using my debit card on PayPal. And they helped themselves to my bank account. It put my account in an overdraft and they were never authorized to use that debit card or bank account. I had to close my bank account and open another one and get a new debit card.

There were many forms to fill out and the bank went after eBay. I was told by the bank I wasn't the first person who had a problem with eBay or PayPal getting into their accounts and taking money. I don't know what happened to the eBay of years gone by. I guess they have gotten so big that they don't care about their customers. If it wasn't for the sellers, there would be no eBay. Well, this is one seller who will no longer use eBay or PayPal. Be careful if you continue to use either of these companies, as they will rip you off left and right.

Ebay has a promotion called "Daily Deal". The Daily Deal offers products at reduced price and free shipping. Item Number 370410895631 and the Nike iPod Nano armband was $3.99 each and free shipping. Now Ebay also has this really annoying policy of allowing sellers to use what is called "3Pcheckouts". That means I am forced to use and pay through their checkout and can't use Paypal directly. This seller's "3p checkout" charged an additional $2.98 in shipping fees. Even though Ebay's ad says free shipping but no matter what I did, the minimum price was $2.99 in shipping fees. Over 1300 people bought the same item I did too. I am not talking about a couple of people here.

I purchased two and paid $13.96 instead of $7.98 as advertised. I will never buy another Ebay Daily Deal because I am being forced to use those ** checkouts instead of Paypal. Why can't Ebay just let buyers pay with Paypal?

I am a disgruntled eBay seller. First of all, the sellers are the people who generate the income for eBay. We must pay insertion fees and get charged Final Sales Fees. eBbay only protects the buyer. A woman purchased jewelry from me, and the package was lost in transit. She contacted me to ask why her package was lost, like I knew?

She started sending me multiple email messages per day, each email getting nastier in content. I tried being helpful and contacted Pennsylvania Post Office to help locate package. Instead of thanking me, she became even more irate. I finally contacted PayPal and told them that I needed her to be refunded immediately in order to stop the harassing emails. The credit was processed.

She became even more enraged and demanded her package. Lastly, she left me negative feedback. I had perfect feedback until this woman came along. She was not justified to leave me negative feedback. I did not lose the package, and I gave her a refund. The funny thing was the package showed up at my door the next day. I made a typing error on the label.

I contacted eBay about the 18 email messages I received from her along with the 4 messages she sent to my personal email. I requested having the negative feedback removed. Oh yeah, I was on hold for over 1 hour. A non-English speaking girl just kept repeating that the buyer has the right to leave any feedback she wants. This woman called me a liar in the feedback. I, on the other hand, do not have the opportunity to leave the psycho her negative feedback.

If eBay allowed buyers to receive negative feedback and then let sellers put a block on buyers with negative feedback, we would avoid a lot of time wasted on the phone. eBay really needs to analyze their current feedback system. And I have decided that I am no longer going to sell on eBay. I will do just as well at local flea markets with my jewelry.

eBay, I hope that you read this and seriously consider treating your sellers with the respect we deserve. If we all stopped selling, how would that affect your bottom line?

When I went to the box office, they looked up the tickets and said that everything on them had been altered and they were fraudulent tickets. I had them make me a copy of the fake tickets they gave me. I was not able to use the tickets purchased by the vendor and had to buy another set of tickets. On January 2, 2010, I won an auction listing on eBay for Microsoft Windows 7 Professional (32-bit) and paid $152.50 to the following eBay seller: Randy J B. Blackburn Rd, Friedens, PA 15541-7305. The listing was falsely advertised as a legitimate unopened box of the Microsoft OS. I received what appeared to be an authentic software DVD from Microsoft with the proper security features, however, he sent Original Equipment Manufacturer (OEM) software (i.e., restricted for sale only with a new computer) in a cardboard CD mailer with the product key handwritten on the paper CD jacket. I installed the software as an upgrade over an existing Windows XP professional installation on a new computer that I had purchased a month earlier.

I used the "Windows AnyTime Upgrade" method of upgrading to Windows 7 Professional. The installation was completed successfully and the product key was accepted. However, to my dismay much later, the operating system was improperly licensed following the install because the product I was sold was OEM software and for use only with another computer, not mine. The system ran fine for months until the Microsoft Windows Update feature automatically installed Microsoft Update #KB971033 months after I purchased the OS from Mr. ***. Microsoft began checking for validation of the operating system which is why it ran fine until then. Following the update, the operating system continued to fail validation with several Windows 7 features disabled until the system is properly licensed. There are about 1 in 5 installs failing in the world due to a number of issues (http://***).

I informed the eBay seller of the problem, requesting either a refund of the full purchase price following my return the DVD or to send a valid product key. After some resistance and unwillingness to cooperate, he offered to send a windows 7 Ultimate DVD with a new product key and a written claim that it is unused by anyone and should solve the problem. I returned the original software DVD to him and received another OEM software release DVD of Windows 7 Ultimate and a photocopy of the official licensing document provided by Microsoft. I performed the upgrade to Windows 7 Ultimate. Since the original Windows 7 Professional license was invalid, the upgrade to Windows 7 Ultimate was also rendered invalid.

The only way to properly license the operating system is to go online at Microsoft.com to purchase a Genuine Microsoft Software product key. The cost of a valid Windows 7 Professional license using this method is $150 (which would have been covered by the proceeds from a refund had the seller agreed to my refund request. However, because he falsely advertised the original sale, then misled me to upgrade to Microsoft's top-of-the-line Windows 7 product, assuring me that the upgrade and new product key would solve the problem, now the cost to license Windows 7 Ultimate is $200, exceeding the amount of any refund and thus costing me more money, time and aggravation.

When I confronted the Mr. B. regarding the inconvenience he has caused through his lack of integrity and character to fix the problem, finally he agreed to a full refund using Paypal (the original payment method) following my return of both software DVDs. He has had possession of the DVDs for over 1 month, my money for over 7 months making, and continues to make empty promises that he intends to issue the refund, although I have yet to see a credit to my paypal account.

Please beware, Mr. B. is a scamming low-life with nothing better to do than prey on others by falsely advertising, selling counterfeit or OEM software and then stealing money from others to live on. eBay members beware and do not do any business with this scammer! Loss of money, time and impacts to the computer affected. Lack of a valid Windows 7 license results in certain features being disabled. This is my personal and business computer that I depend on as a professional. Not having certain automatic updates from Microsoft subjects the computer to unnecessary risk.

eBay does nothing to protect the seller from scams brought by buyers. I had a buyer that lied about receiving and item that she claims was not as listed. The listing for this item I sold her was detailed and described quite carefully.

PayPal and eBay ignored that I had a no return policy to my listing also. They proceeded to give her a refund even though she lied about the item's condition. My 100% rating was ruined. Also, the hammered me with lies on my feedback field.

PayPal and eBay did nothing to help me as a seller. Because this buyer said she won her claim in public, now, a second buyer that had purchased an item from me a month ago is now trying to follow in her foot steps. This is ridiculous, a month from now and PayPal is accepting a claim on this!

Now I have escalated the dispute. This second liar said, she tried to contact me several times about the item and she never did. Now, my PayPal account is negative as they put a hold on the funds to review the case. I am sure that she will also bash me on my feedback to just to back up her story. I have had it with eBay and PayPal!

They do nothing to protect us, sellers. However, they sure love to receive our seller fees. I am cancelling my account with them.

After repeated complaints to eBay about their policies, I have not even had the courtesy of a reply. Here is the last complaint which has gone unanswered. After repeated frustrations with eBay and your refusal to acknowledge them, I am left with no alternative but to sever all contact with you. Our frustrations are as follows:

1.) You insisted that we had to state shipping charges on each listing. This is impossible since we have shipped all over the world and buyers have a choice of how they want their items shipped. You refused to even acknowledge my repeated protests at this ridiculous policy. 2.) Your stupid policy above required us to say, "No shipping, but local pick-up only." This cost us sales, despite our trying to state in the description of each listing that we would ship anywhere and asking buyers to indicate their location and we would then respond with a shipping cost be it to Australia, Sweden, Holland, UK, USA, etc. 3.) Ebay consistently refuses to acknowledge criticisms.

4.) Ebay refuses to acknowledge that some buyers are bad news by disallowing negative feedback for buyers. 5.) Ebay refuses to acknowledge complaints made about its systems, policies and generally acts in a high-handed manner as though it can do no wrong. 6.) Ebay dishonestly withholds buyer payments despite our excellent record. This was the final straw! 7.) Ebay refuses to acknowledge complaints made about a devious buyer who refuses to supply his correct address, after eBay and PayPal gave us conflicting addresses for this buyer.

8.) This buyer was abusive, accusing us of running "a Nigerian scam" and refused to confirm his correct address. Ebay refused to even acknowledge our report. We could not ship to an unconfirmed address, and therefore, refunded his money which you, eBay, were holding onto, and we had no alternative but to cancel the transaction. Had we shipped the item, despite not receiving our payment, we stood the chance of losing both the $255 item and our money. 9.) Ebay staff are totally robotic and unhelpful and your resolution process is stilted and almost impossible to navigate. You simply do not allow us to state the problems we are having clearly and simply. 10.) Ebay avoids phone contact and the "Contact us" facility is a disaster.

We could go on and on, but the above summarizes our total dissatisfaction with eBay. In the light of previous unsatisfactory experience, we doubt that you will listen to the above criticisms and do anything to correct them.

I bought a 2 carat engagement ring set off at eBay last year from Dales Diamond Store and have had to send it back twice to get it fixed. Each time they come back, it’s worse. Both rings come back in different sizes. The centre diamond setting is crooked and there are gaps in between the diamonds on both bands. I even paid to get the rings resized at a local jeweler who evaluated the set and said they couldn't straighten the centre diamond setting as there were cracks in it. I keep sending them an email to rectify the matter but they are quite rude to me.

I've asked for the manager to call me, and they keep avoiding the question. I'm at my wits’ end. I want perfect rings but feel like they are taking advantage of the situation as I am from Australia and paid a lower price through the auction bid on eBay. Postage costs me $100 AUS from here so that is $200 I have spent all up in postage which they said they would refund and have not. They emailed me and told me if I wanted a better quality set but I am to pay $200 US for a better set that they would rebuild.

I feel like it’s just a big scam to get more money! I have spent that in postage which they haven't refunded and I have now told them to upgrade for free or give me my money back but they won't. One of their emails came back said that I can get what I paid for. Regardless if they put the item up for auction on eBay, the item should be of good quality. What does an overseas buyer have to do to get what they want? I have asked for a refund or even an exchange but they keep avoiding those questions too. There are other people who live in America who have had the same problem via eBay. Something needs to be done about this to ensure that happy customers keep returning, not outing their business. I know for sure, I will not be buying from America again. Sorry.

About a month ago, an item for auction #** was shipped out to Ms. R. of California by USPS but it never arrived to its destination. The item should be covered under eBay's seller protection policy (which will be referred to as policy herein).

After contacting eBay, I was instructed there are additional conditions that were not mentioned and were only disclosed 'post facto' creating a false sense of protection which did not exist. All conditions of the original policy were followed; such as but not limited to: promptly responding to any inquiry, promptly shipping the package with a trackable shipping method.

All conditions of the policy were followed but eBay will not enforce the policy and insists there were other conditions not mentioned that were not met. Several attempts were made to contact eBay and PayPal regarding this issue, all resulted in additional conditions that were not mentioned on the policy; such conditions that were not mentioned are: the item must reach its destination, the item must be insured (and claim must then be made to the carrier-USPS).

All attempts for a resolution and or reaching an amicable agreement were futile. eBay also took a sales commission on this transaction which was thought to cover such incidents. Resolution sought: I would like eBay to remove the credit hold of $320.50 from my account. I would like eBay to change and clarify the seller protection policy on their website so no future misunderstanding can occur with future transactions.

The seller first tried to blame the bent rim on UPS (even though there was absolutely no damage to the box or to the rest of the bike). He then offered a refund, but it would have been very expensive for me to ship the bike back. I would have ended up losing money on the deal. The seller refused to explain why the bike was misrepresented, except to say that it was used and that the description was his opinion of the bike. Excellent condition connotes no visible defects, and this bicycle was far from free of defects. I am very angry that this individual thinks it's okay for him to rip people off. I'm guessing he knew that I wouldn't want to take the time or lose the money to return the bike.

The seller did not respond at all, even not to several emails I sent. Only when I opened a complaint case with eBay he sent a lame excuse that he couldn't ship the item. I'm convinced the seller was making up a story because he didn't get enough out of the item. eBay didn't do anything to serve justice. Here’s the original lame email from eBay:

    "Dear Hubert,

Thank you for contacting eBay in regard to item **. I understand it can be very frustrating to have to open case in the Resolution Center to get a problem resolved, but I appreciate your willingness to work to resolve this situation. We understand you wanted the item and still haven't received it. When the case was opened, we did our best to communicate with the seller to try to get them to get the item to you. In the end, they couldn't get it to you in time. We had to fall back on the refund as we have no way of physically "forcing" the seller to send you the item. Ideally, we would have loved to get you your item. I hope that a refund will suffice given the circumstance. One great thing about eBay is that there are nearly 100 million active users and I’m hopeful and confident that you will be able to find the same or a very similar item for around the same price.

"In addition, we encourage you to leave the seller appropriate feedback. Don't worry about getting negative feedback from the seller because sellers can only leave positive feedback for buyers or no feedback at all. Finally, please make sure that the email address on your eBay account is added and confirmed on your PayPal account to ensure you receive your refund quickly.

Here are the steps to confirm your email address with your PayPal account: 1. Log into your PayPal account at paypal.com. 2. Hover over the "Profile" link under the "My Account" tab. 3. Click on "Add or Edit Email" from the drop-down menu. 4. Select your email address and click "Confirm". 5. Check your personal email for an email from PayPal. 6. Thank you for being a valuable member of the eBay community! We truly appreciate you on our site.

On eBay, a seller, Cold Fusion Nitrous (cfnproducts), sold to me a mobility scooter, which he called a QA1 Scooter. It was stated to have been engineered, assembled, and tested in the US. He stated that the battery was a quick disconnect for fast removal. The pictures looked very nice, showed anti-tip wheels, and seemed to be a good deal. The seller had good ratings, so I made my first eBay purchase. When the scooter arrived, it didn't have anti-tip wheels. The seller stated the model didn't come with any. When I asked why the brakes didn't work right, he stated my scooter didn't have that. When I asked where the free wheel lever was to keep it from rolling while trying to get on it, he stated it didn't have one, yet the manual he sent stated safety features, that is not there.

As a matter of fact, the manual was for a Biswift Qx-04-05C, Qx-04-05A, which is Chinese made. He stated the manual was for 5 different models. When I questioned him on whether or not the scooter was a Biswift, he stated he was under no obligation to list the model for the scooter, that it was an internal part number. If you're confused, it is because that is exactly where the seller wants his buyer. eBay sided with the seller, and as I have found out eBay has numerous complaints against them.

The seller can apparently advertise a Ford, and sell you a Honda if he wants to, and so can any other seller from what I've read. I will never purchase from eBay again, nor would I recommend anyone to, and would advise them not to. Prices from well known businesses with good consumer policies, practices, and politeness are very competitive. Unfortunately, because this purchase was for a mobility device, due to disability, I had to purchase another scooter. I am out the money spent on this unsafe and poor quality scooter, plus what had to be spent on another scooter elsewhere.

The handling fee still didn't show up on the preview, so I asked her specifically if it would show up on the listing once it was actually published. She assured me that it would. So I went ahead and published it. It did not show up and someone bought the needles.

When I contacted eBay about the problem, they wanted me to bother the customer for the handling charge. I told them that this was not the customer's problem and I was not going to try to charge them for it. I think that eBay should be compensating for this because they did not provide a service that they said they were providing. I do not even care so much about the $3.00. It is the principle of the matter that is the issue. I spent over an hour trying to talk some reason into the representatives that I spoke to after I found this mistake had been made. They were "apologetic", but offered no satisfaction and it took way too long to get them to give me an address that I could send a complaint letter too. By the way, I could not find that information anywhere on the site.

eBay consumer protection is a fake facade. Thieves and criminal could take advantage and sell you items that don't belong to them and eventually have authority confiscate them. eBay will politely tell you that it’s out of their hands and ask you to pay for confirmation to send the stolen item back to the thief and they will refund your money. You can tell them that it has been confiscate by police and they will neglect common sense and insist you send back the stolen item. There are ingrained loophole that bad seller can use to prey on buyer and eBay will ignore that a problem exist.

I am giving these people until the 12th to receive this okay. But I did ask customer service about this item and they are not responsible about this, but they should reassure a person that their item is on. It's not, they didn't. I feel like I got ripped off. I tried to contact the seller. Nothing, no reply. I reported it, nothing. No one steals off of me, they're in trouble. I don't care who they are really, but not notifying the buyer and no item yet, that's **. A nice way to put it.

I purchased a vintage radio from eBay seller, TheToneFarm, using PayPal. The radio arrived damaged and was materially different from the sellers description. When I tried to get a refund from eBay under their Buyer Protection plan, they did a bait and switch and my complaint was handled by PayPal, who denied it without comment. I tried again to get a refund from eBay under their Buyer Protection plan and they refused because it had already gone through PayPal. I gave bad feedback to the seller, who got my private email address from eBay and sent me a life-threatening email. eBay and PayPal had no right giving out my personal information and endangering my life. They refused to do anything to the seller and didn't even apologize. The seller then offered to cancel the transaction, which I accepted. I returned the radio but the seller then refused to refund my money. Again, eBay refused to do anything to the seller or refund my money. So I'm now living under duress from the seller and am out the cost of the radio, the radio itself and the cost of shipping it back to the seller.

They give buyers my shipped items and their money back. Paypal does not accept an official hand stamped US Post Office receipt as proof I shipped the items. One buyer actually left feedback saying how nice the item was just to rub it in. I would like to encourage all buyers that are having items shipped via First Class Mail to them to immediately always claim to Paypal that you didn't receive your item. Most of the time, you'll get your money back and get to keep the item when it arrives if it hasn't already. The uproar will hopefully force them to stop the ludicrous policy of not accepting an official Post Office Receipt as proof of seller's shipment. This will allow many more sellers to offer less expensive items both domestically and especially internationally. That inflexible ridiculous policy is just one of the many reasons you are not seeing quality collectibles offered on eBay by trustworthy low volume sellers anymore.

eBay is allowing scammers from (especially China) to operate freely on eBay list where they are dumping rubbish metal and cadmium which is a carcinogen listed as solid 14k gold plus genuine gems. I have been reporting and complaining to eBay for over two years with minimal results, but which caused the expulsion of about 200 sellers, but eBay still allows dozens daily to scam the public in the huge amounts of millions of dollars. I also try to warn the buyers that they were robbed and they should get their money back and most do, but the *** at PayPal restrict me to only three emails a day. So most victims have to suffer the losses.

I have a list of over 200 sellers, who in my opinion are members of the Chinese crime syndicate, who are still peddling their crap on us with impunity even after dozens of complaints from me about each and every scamming seller. A fresh item is a seller listed as Shanshanlai, dumping rubbish rings listed as "14K Solid Gold sparkling white diamond aureate ring, 100% 14k Solid Gold 100% Satisfaction Guarantee. Brand New and Handmade by Master Jewellers, Item is fine polished, Metal, Solid 14k Yellow Gold (14K Stamped). Accent stone: Diamonds carat 0.22 round brilliant clarity SI-1, Color: G-H-I. Estimated retail value $2999. Price? Buy it now: $18.88 with free shipping."

Now this *** has already sold 11 rings and I am unable to reach the buyers because eBay and PayPal will not allow me access to the victims. I reported this seller to eBay but it may take up to 14k days before any action is taken. I have helped hundreds of buyers to recover their losses, but again the nice people at eBay and PayPal do not appreciate my efforts. Perhaps, it may interfere with their bloated profit margin.

Recently, Ebay has become actually abusive in their treatment of the sellers while their prices have spiraled.I have recently experienced a problem which prevents me from selling effectively on Ebay. I have desperately needed to get an answer. After half an hour in the online customer service maze, I was offered a chance to do an online chat. Sadly after a fifteen minute wait, no one was available.

Next, I spent another fifteen minutes trying to find out how to email them. You cannot email eBay without a pin which takes another ten minutes of wandering in the maze. Once you get the Pin, you can expend your time and effort carefully explaining the situation. After a day or two, I got an answer saying I had to phone in if I wanted an answer. After asking me to explain the problem in detail, my message id was not even read, just dismissed with a form letter to phone in. I tried to phone. That took another fifteen minutes of wandering the redundant online maze to get a pin. I phoned. I entered the pin. I was placed in a infuriating redundant maze which offered no solution and no human.

After another fifteen minutes, I tried pressing the 0 repeatedly until the maze ended. I was placed on hold more or less permanently. After several tries at various times and days, all I could find out was that Ebay was unusually busy all the time and would never speak to me or solve my problem. Ebay exists only to take 10 to 14 percentage of sales before turning us over to PayPal to be relieved of another 4%.

I just happened to get into the hobby of coin collecting within the past 6 weeks and bought 15 items from eBay; one cost $1,000. Now, after waiting a week and a half for the item, I bought the item (a silver Morgan) on April 5, 2010 and had not received it by April 13. So I called eBay to complain. The seller responded by claiming I signed and accepted the coin on April 8, 2010 at 2:20 pm and that I must have lost the coin. The brain-dead at eBay bought that excuse.

It just so happened that I was at work reviewing a project, especially at the so-called time I signed for the coin. After the "7-day review period," eBay ruled in favor of the seller. Ironically, eBay sent me an email on April 14, 2010 (the very next day) saying "the item has just been shipped." I got a notice from the post office on April 23, indicating there were two packages I needed to sign for.

On Friday, April 24, 2010, I went to the post office, and guess what, lo and behold, there was the coin I supposedly received on April 8, 2010. According to the seller, I have a three-day grace period in which I can return the item. The eBay brain-dead told me not to worry and to contact the seller and wait three days, then start the dispute case and that I am "covered" by the "eBay buyer protection program."

I asked for written guarantees or documents that confirm what I was told. There was a lot of hesitation and reluctance to provide me with that information. After some time, he referred me to the text discussing the buyer protection program. When reading the text, I realized it's nothing more than a seller protection program. Their "recommended / highly rated sellers" bring a lot of cash to eBay, so I suspect they will rule in favor of the seller again. I hope that is not the case. To be considered a "recommended / highly rated seller," a person need only bring in $3,000 a year.

I bought and paid for (via PayPal) a 1936 Conn Vocabell trumpet, an eBay seller had picked up at an estate sale and had listed at a "Buy it Now" price. Two days after paying for the item, I received an email from PayPal stating that the transaction had been cancelled, and the following message from the seller:

"Hi, I`m sorry to have to tell you this but i made a mistake with this trumpet. I've gotten a few emails telling me I sold it too cheap and offering me more that what I sold it for. I'm going to have to cancel this sale and send you a full refund. I sell for a living full time and good items are so hard to find. I have to get as much as I can. I hope you understand and I'm very sorry about this. Ken. **.

The seller re listed the item at three hundred dollars more than the original listing and it appears today, sold the item for $200 more. I made numerous attempts to get eBay to stop the re listing, not allow the seller to profit from breaking the rules, and just plain enforce their own policy in the face of blatant violation, but to no effect. For all the many responses I received from customer service promising action, they didn't take down the sellers re listing or take any action to ensure a properly entered transaction was enforced.

Apparently, anything goes at eBay and rules, policy, honest dealing, and enforcement of the most basic standards necessary to ensure a viable market place just don't exist there. Their response? Give the seller negative feedback. I'm through with them. Between the misrepresented worthless junk in their listings, never-ending fees, and eBay refusing to enforce their own most basic rules. There's no fun in it, let alone profit.

I lost the value of the item, which may (or may not) have been a few hundred more than I paid. But mostly, I feel cheated and abused by a dishonest marketplace that promises fairness in their stated policies but allows those policies to be broken with impunity by "Power Sellers".

In short, because of the economy today, I decided to sell inexpensive photos in a digital format. People responded by buying them world over. Although it wasn't very much money, it started to add up and eBay pulled the plug. They, without warning removed all listings, and wrongfully accused me of 'feedback' manipulation, suspending my account.

I did not violate their policies, as I looked at each one by one. I've written many letters (politely), with no avail, other than form letters (some of them repeated word by word). Wrongful accusation, suspension, without a platform to defend one's innocence is wrong. Economic losses, and my reputation that I've built in 10 years ruined.

I have been an eBay PayPal seller for years. I have a computer business and sell off used and unneeded hardware through eBay using PayPal as a payment service. I have many areas I am frustrated with and I will list them here. I am also contacting the states Attorney Generals office about eBay/PayPal to see if they are breaking antitrust laws.

Complaint #1 (eBay forcing us to use PayPal as the only means of collecting money from our auctions). If you sell on eBay you know we always have had multiple choices in collecting money for auctions. PayPal has always been an option; we were also able to use our own merchant services, request money orders, use Western Union Bill pay, Bid pay and many other forms of payment. Try to list now and you will find the only feasible way to collect payments for eBay auctions now is PayPal. This is not because PayPal is so great but because eBay has changed their policies and we are now pressured to use PayPal. Is this not an antitrust matter?

Complaint # 2 (Feedback on eBay). We, as sellers can no longer leave feedback. I once sold a laptop to a man in California. He contacted PayPal and told them he was not satisfied with the laptop and that I had misrepresented the item on eBay. PayPal found in his favor and as soon as he sent tracking info to PayPal on the return of the laptop PayPal took the money from my account and refunded this scammer. When I received the package there were blocks of wood in the box not my laptop. PayPal placed the burden of proof on me and being I did not open the package in front of the UPS driver, they done nothing. I lost my money and my laptop. The jerk even had the nerve to list bad feedback on me to make him look good.

Complaint # 3 (PayPal rolling reserve) PayPal now holds 10% of everything that comes through my account with them for 60 days. Now eBay is charging about 6% you make maybe 10% profit on the sale then PayPal holds 10% for 60 days. This means sellers are left with a - 6% profit loss for 60 days. The only ones who can handle this are the huge sellers and guess what? News flash! They are reviewed differently, then the smaller seller and they do not have as much held in rolling reserve nor are their funds held as long. I know this because I know Power sellers. So we are at a loss right out the gate if we use eBay and PayPal.

I called PayPal to voice my concern and a "Roger" who claimed to be a Sr rep. told me in a very nasty and arrogant voice that I could leave eBay and PayPal if I wanted but they didn't care because I would be back. He also told me his supervisors name was Lorie but that he had the power to tell me I could not speak with her. Later I called back and spoke with a Patrick whom forwarded me to Mike, Mike was very nice once he knew he was being recorded and he promised that the loss prevention division would contact me within four hours. He also informed me that there was no way I could call that division direct, they would have to call me. I am reporting all this to the Missouri State Attorney Generals office and they want the physical address for PayPal. Guess what? It is not listed on the web site and none of their reps will let you have it.

I plan on closing my accounts with both eBay and PayPal and going with eBid and Google Payments soon. It is apparent that eBay no longer wants the small sellers around. As a result of eBay/PayPal policies in listing fees and PayPal holding 10% for 60 days, I have to carry a 6% profit loss for that time period. That 6% has to be pulled from money intended to pay other bills. The buyer has my product, eBay and PayPal have their money and I have a rolling loss due to PayPal's rolling reserve. PayPal told me (recorded) thanks Mike, that "eBay's guaranteed buyers protection" is why there is now a "Rolling Reserve" at PayPal. They want the two companies to be looked at as different companies when it is convenient.

I purchased a Red and black contemporary sofa from LA furniture via eBay! I called prior to purchase to confirm the red was primary red rather than some off color. I paid 1895 dollars for the sofa. While waiting for the sofa I painted my living room, two of the walls, primary red.

When the sofa arrived I was horrified to discover that the color was reddish orange and immediately contacted the seller who admitted fault. He said he "called the warehouse and asked about the color rather than actually checking it himself". He promised to 'make it right' and I waited. The next day my husband and I went to move one of the pieces of this section to another arrangement. When he went to push the sofa he was stabbed in the finger by a nail that had come through the leather from the inside of the sofa. We discovered that it had torn the sofa and shredded the back of the cushion that rested against that part of the back. I called Oleg at LA furniture again and told him about the defect and the damage done by the defect. One of his managers actually accused me of having stuck the nail inside the sofa because I didn't like the color. Again Oleg assured me that he would contact the manufacturer and 'make it right'.

When he called back he suggested that he would refund $200! I asked him what the price difference between a perfect and 'damaged' sofa would be. He replied that he wouldn't sell a defective sofa. I said "so, as far as your concerned, a defective sofa has no value? " he started hemming and hawing.

Having exhausted my patience I contacted eBay buyer protection. The first thing I received there was a note telling me that if I chose to return the sofa for a refund that I was responsible for the freight shipping (495 dollars worth). So returning the sofa meant I was automatically out $500! I think that outrageous. Did I feel protected? No! Can anyone afford to just toss out $500? I doubt it!

Even if they sent a replacement that means I spent $2400 for the sofa, not the amount I agreed to pay in the first place. So sending it back wasn't an option. So I waited, and waited, and waited. After a few days, I received a $200 refund from LA Furniture. So, apparently the difference in price between a new high quality leather sofa (correct color) and a torn leather sofa with a shredded cushion and that is the wrong color is $200!

Naturally I went on and left negative feedback! I stated in my feedback the eBay buyer protection would not help! Guess what? Ebay, who had waited days to even give me that sham of a refund, immediately removed my feedback because apparently you are not supposed to tell people that eBay's buyer protection won't protect them. That's a secret and eBay makes sure it stays that way!

Now the hole is about as big as a quarter. It tears if anyone sits on it ,so I will have to pay to have it repaired or it will get bigger still. The cushion will have to be remade. From calls I've made it is going to cost between $200-350 to repair. So, for 1900 + dollars I will, after considerable legwork, have a repaired leather sofa that is the wrong color and will have to repaint my living room to keep it from clashing at the cost of over 200 more dollars.

Total cost? Well, over $2000. End result, a firm belief that Ebay will protect their scamming sellers because that's who pays them. They will even become an accomplice to the fraud if you try to warn others from being conned! And LA furniture thinks that if you send them money, they can send you any defective piece they happen to have lying around even if it's the wrong color, and you're stuck with it. And since they get away with it and eBay removes any warning placed by buyers, they will continue to do so. But don't you worry, they'll pay eBay the required listing fees! And we all know that those fees are what eBay really cares about!

When it comes to international shipping, eBay punishes good USA sellers and rewards bad foreign buyers/customers. I sell vintage accessories under $20 on eBay, Power Seller, 100% Positive Feedback. My biggest and most recurring problem has been international customers, who falsely claim non-receipt and/or file Paypal charge back. This happens about 4-5 times a year and I've lost money each time. Why? Because the proof of delivery solely rests on the seller, no help from eBay/PayPal...even if the buyer/customer is bad, with a history of falsely claiming non-receipt.

First, I must explain I ship the USPS 1st class mail international, the cheapest way for both seller and buyer/customer...I mean, who wants to pay $25-$35 for shipping USPS Priority/Express/UPS/FedEx for items under $20? Even if it has delivery tracking number? It doesn't make sense to pay more on shipping than the actual item.

The first time I've had a bad experience with an eBayer from outside the USA, it was a customer from Italy. He e-mailed me, "I'm gonna make trouble for you with eBay if you don't send me again. " Threatening negative feedback is a common tactic to extract money (or items) from USA Sellers, I later learned.

According to eBay/PayPal, I had 2 choices. 1) Talk to the customer and work out an arrangement solution..haaha 2) Give him his money back, unless I had delivery tracking number to prove the Italian customer received the item to his address in Italy. I shipped it USPS 1st class mail international (standard international shipping; no delivery tracking), so I could not provide proof. I had more of the same items for sale, so I told the customer I'll re-ship the item to him. And after doing so, just out of curiosity, I looked at his feedback....he bought similar vintage accessories from other USA Sellers.

So, I contacted 3 of the USA Sellers on his feedback, and yes, they told me the same thing...It happened to them as well - the Italian eBayer told them he didn't get his item, so they either gave him his money back or re-shipped the item to him....that ** knew he could get away with extracting free stuff from USA eBayers. So he did it again and again and again. And last I checked, he's still an active member of eBay, with a 100% positive feedback (because nobody can leave negative feed backs to customers....negative feed backs can only be left for sellers).

So this kind of thing happened again and again with eBay buyers/customers from Brazil, Latvia, Argentina, and Italy, and Croatia, and Turkey. And I've lost money each time, because there was no proof of delivery shipping USPS 1st class mail international (trust me, a receipt from the USA Post Office saying you paid $5.95 postage shipping to Brazil, does not mean a thing to eBay/PayPal, because it only shows you shipped the item; it doesn't show the eBay customer received the item). Frustration, frustration, frustation. You have proof from a USA government agency that you mailed out the item, but eBay/Paypal says no; that's not evidence because it doesn't prove the international eBay customer got it in Brazil, Latvia, Italy, or where ever).

Nowadays, though, eBay/Paypal will automatically deduct/take money from you (your PayPal account), immediately after a non-receipt/chargeback is filed from an eBay customer......Even if you have proof of delivery with a tracking number.

This just happened recently. An eBay customer from Turkey bought an item from me for about $165.00. Now, this item was over $100. So, $35 USPS Express Shipping was required. The eBay customer received the item on 2-27-10 to his address in Turkey. And I have the delivery tracking number as proof and additional paperwork. He filed a credit card chargeback via eBay/Paypal and, I've submitted all the paperwork proof of delivery, but that doesn't matter to eBay/PayPal.

The $200 I received from the eBay customer is on "temporary hold" on my Paypal account, meaning I can't use it, pending further investigation of the chargeback. And additionally, PayPal took out an extra $10 fee to "fight" the chargeback on "my behalf." Now, that's a laugh.

So be warned, if you're a Seller on eBay, and a buyer claims non-receipt of item or files chargeback, they (they-meaning eBay and PayPal who are the same one company) will take your money from you to cover the Buyer, but not you-the seller. So if you're a seller, be ready to be ** on a daily basis.

    I stopped selling on eBay.

EBay's return policy is that despite the condition of merchandise you are sold, you have to pay to ship it back. Recently, I bought a dry mount press which seller said in item description he would ship out in 2 days. Three weeks later, no press. I had sent seller at least 4 emails and never got an answer. Filed a complaint.

A week later, box arrives damaged. Press had been put into a flimsy cardboard box and broke though the box. Emailed seller and told them it had arrived damaged and I wanted to return it. Seller offered to pay for return shipping, but asked me to open it first to make sure it was damaged. When I sent him an email to confirm, he would handle return charges, he hemmed and hawed, then begged me to open it, saying it could not be damaged. It was. And because I opened it, I could not refuse the package and had to pay for shipping back. It would have cost $80 to ship it priority so I shipped it parcel post. Because i didn't have a tracking label (which you only get if you ship it priority,or use UPS), eBay decided against me. If merchandise is defective, buyer should not have to pay for the cost of return shipping, $240.00.

In the end, eBay gives the buyer a refund. Ebay has lost all respect. I will never recommend anyone selling on eBay.

I purchased an item through eBay from Home & Fine Arts, which is also known as Hot Antiques. It was a gold food server with wood carvings, black marble top, and three paintings in the front three drawers. Item number is 1802232937. I was making payments through PayPal on the item, since it was $1200 and I didn't have all of the money. When I completed my payments in October 2009, I asked Allen, the owner, when he would send me the item. When I received a response a couple of days later, he said it was missing from the warehouse and that he would order me another one.

About a week later, he said he received the same item in and would send it to me. Well, he sent me a totally different server which is just plain gold color with no details and old-looking knobs. So I immediately called him and asked him about it. He said he would get the correct one in shortly and send it to me and pick this one up.

I have been calling and calling them for months now, and nothing. I talked to Susan, and she said she had no idea when the one I wanted would come. Then they ignored my calls or if Allen answered, he put me on hold then the phone hung up or they said they would call me back because they have to talk to Allen. And they never bothered.

My last call and also email sent to them yesterday, March 10, was asking them just to pick this wrong server up which is still sitting in my living room all wrapped up in cardboard and just to issue me a refund for the $1200 I paid through PayPal. But again, no response. Susan had offered me a discount of $200 if I just keep this one, but I honestly do not like it and just want my money back. She said it would be too much money for them to pick this wrong server up. I told her it was not my fault they sent me the wrong one and I should not have to be the one to just accept the wrong item and I should not be forced to keep it.

Then she said she needed to talk to Allen, but she kept telling me Allen was not in and she hadn't talked to him, so she didn't know when he would be back. Mimi is Allen's sister. Obviously, Susan nor Allen had ordered the right server, because yesterday, she told me that she was calling the manufacturer to see if they can send the one I want if they still have any. She wanted me to give her time, but I told her I have given everyone time and I got the runaround. They just wanted me to be quiet and keep the wrong server and keep the $1200.

I had to even go as far as to dial *67 before my number when I called them in order to make my number private, so they would answer not knowing it was me. Sofia said she would talk to Allen to try to help me. Again, I never heard back from her. Anna said she didn't want to get involved and would not give me Allen's last name. I have talked to Susan, Mimi, Sofia, Anna, and Allen so many times from this place, and no one has helped me. It only takes 5 minutes for someone to request a pick up and then just log on to PayPal to issue my refund. They just kept ignoring me or giving me the runaround. Please help me!

Like many sellers, I saw the other side of business on eBay. I sold full-time for years, keeping excellent feedback and building a customer base of almost 5000 happy customers. I was also a Power Seller for most of that time. Two years ago, over Christmas holidays, I noticed a strange absence of personal emails. My computer also shut down every 15 minutes or so. I have MSN XP operating system, and the computer was newer.

I went through all channels to fix, calling MSN, etc., etc., etc. for three months. Since I was operating a successful eBay business, it was a real handicap to keep up but I did. MSN could not find the problem, and I had Norton antivirus which tested clear, free from problems. By March, I noticed a strange thing with my eBay accounts. Items that were "paid" were switching to "unpaid," and as with all "unpaids," I notified buyers through eBay emails with no answers. Then those who bought more than one item appeared to pay for all and then took back payment on one! Really strange. I contacted eBay again and again via Live Help and got the runaround each time.

Meanwhile, my computer was still shutting down, few emails appeared, etc. On eBay, members cannot directly contact technical support. An email is sent which is never answered, except by a "canned" response. I did that many times, contacted various people at Live Help. It's very frustrating to run a business like this.

Finally, someone on Live Help happens to mention that yes, eBay knew there was a glitch/problem with accounts in PayPal changing status. They were working on it, and I should "just mail everything out, even if it looks like it isn't paid." No fix came. The emails between seller and buyer were cut off within eBay, so I began to receive numerous negative feedbacks for non-communication and not mailing out items paid for. eBay's Live Help indicated we would be helped by reversal of negative feedbacks, and luckily, I saved copies of the conversations as the negatives were never reversed. I think I got twelve.

When the problem was finally fixed, eBay did not clean up the mess left. So we had to go back and manually check for payments in PayPal, etc. eBay took a month to fix problem, and during this time, I did get an excellent MSN tech on phone who connected the computer problems with the eBay problem. They were one and the same. He found virus contamination and walked me through hours of fix ups.

Obviously, eBay had known this affected XP users, but ignored our problems for months and let us take the "bullet" for the problem and ignored us. My feedback went down to 99.5%. Thank goodness, not a bad score as I had thousands of feedbacks.

It gets worse. A month later, eBay decided to start a new feedback program which used only newer feedback and considers all neutral feedback as negative feedback. My feedback fell to 85%, and I was suspended. eBay was contacted and reminded that the negatives/neutrals were to be taken off for the virus contamination issue, but no one knew anything about it. And when eBay suspends a seller, it means total cutoff from accounts, customers, and total closure. So I was stuck and could not even contact a lot of the reps.

Within a short time, eBay realized it made a mistake and reversed its new feedback policy. My feedback went up to 99.5%, but I was still suspended. But even when I could get someone at eBay to listen, no one would help me. Just to let you know, I do not have another job; this is how I earn my living.

After months, I was reinstated. How? I don't even know, and I quickly geared up to earn Christmas money. (I believe a 30- or 60-day review reinstated me.) My sales were soaring, and my auctions were closing within a day with one item at $200. And eBay suspended me again. No explanation, no low feedback. No one at eBay had a reason. But some clown advised me to mail items I had already wrapped and printed postage on. So I did. No one knew what caused this suspension. No one knew if it was temporary or permanent. My feedback was not low.

Within a day, eBay went into all my accounts and returned all the money to customers, even though I had mailed all the items out. I lost at least $1000 on these lost items plus hundreds in listing fees that I was charged for listing and selling the items. Again, no one knew anything at eBay why this happened, but it appeared to be permanent suspension. But no one really knew.

Right at pre-Christmas time, one year later and still experiencing this business. So I went to the Wisconsin Attorney General for Consumer Protection and filed. eBay was given 30 days to explain why a good seller who paid eBay some $500 to $800 a month could not get answers. eBay called back and did reinstate me. I was warned to be good, because they were giving me another chance. I promptly told her that I now had my own website and had gone to the number 1 alternative selling site, ebid.net, an English-based auction site and did not plan to ever return.

The rep for eBay did not know what to say. I was supposed to thank her for the loss and the sleepless nights, my bills not getting paid, etc.? I also told her that I had the names/addresses of my 5000 customers and were inviting them to join me. She was stunned. I left my account there as is in case a class action suit ever opened.

I sold there for years; each year, I paid fees between $6000 and $7500 and got treated like this. No reason, no explanation from anyone. There are lots of problems at eBay, one being the ever-changing complicated rules, and the other being a corrupt feedback system. Buyers are babied and allowed to do anything; sellers are given contrary and contradictory rules to follow (i.e., sellers allowed to specify when item is put into mail: "I ship within 5 business days." But feedback asks buyers to rate sellers on "did item come quickly." If seller rates lower in this area, they are suspended!).

Feedback system is corrupt. It can't be changed, even if made in error or there is a mistake. So buyers soon learned they could do anything to sellers, and sellers had to comply or lose feedback and seller privileges. Soon we were receiving negative feedback if an item did not arrive in one day. eBay stood by the feedback.

eBay is very anti-seller; now the rules allow buyers to keep the items if they find something wrong with them and the seller must give money back too. Buyers saying "It doesn't look like the picture." gets free item and money back. You can imagine how that is playing out! It's an absolute mess, i.e., if feedback scores are lower, the seller's items appear on the bottom of the lists so no one sees them; and if feedback scores are lower, sellers are restricted to only a certain number of listing within certain categories. Also, if feedback scores are lower, all payments from buyers are held for 21 days, but seller is required to ship item immediately (Hint: using what for postage? air?).

Sellers are leaving this site in droves, and it is understandable why. New policies are being put in place this month for even dumber "improvements." ebid.net has gotten so many sellers from eBay that our members have volunteered to befriend them and get them selling via the forums. We are swamped with sellers bringing thousands of items over. Their loss, our gain.

I have worked in business for 45 years and have never seen such an incompetent mess of a company in my life. I can't see an out for them over than purging their staff and starting over fresh. Oh, is there life after eBay? There certainly is. Selling on alternatives uses different techniques, but daily sales are possible and new buyers seek us out. To handle the masses leaving eBay, ebid.net members volunteer to help new sellers learn these techniques and get up and sell fast. It's a totally different environment, a better site that learned from the mistakes eBay made.

I lost my primary source of income. I lost thousands of dollars through lost listing fees, selling fees, PayPal fees, photo fees, and store fees when they started and stopped by listing for no reason. I lost my good customers, as my suspension made me look like a criminal. I disappeared overnight without explanation. And I almost lost my expensive computer to virus contamination. eBay knew of the problem and did not fix for months. And they allowed sellers to take the blame for the breakdown in payment status and loss of communication through eBay emails.

I spent three months attempting to fix computer problems, hours on phone to MSN, etc, to fix something that eBay caused and did not announce. Some of my customers had similar problems and had to replace hard drives, etc. I spent almost a year trying to straighten out virus problems, buyer problems, suspension problems, and feedback problems all caused by eBay.

And I pay my bills and keep my family fed and a roof over our heads. No amount of money makes up for the disrespect, lack of emotions/understanding, lack of control, and the things that happen when your only means of earning a living is ripped away--ripped away by a company that does not care. Very bad experience. I would not wish it on my worst enemy.

I have bought off EBay for 10 years now, and have never had a problem. Last year, I decided to start selling on EBay. At first, I didn't really pay much attention to "Insertion Fees", "Final Value Fees", etc. I just ended an auction where I listed 40 Items in 1 Day. EBay was having a 50% off "Auction Style Insertion Fees", so I wanted to list as many things as possible. I worked for 12 hours that day. My listings have all ended, and I realized that between EBay's Fees, i.e., Insertion Fee, Final Value Fee, and PayPal's Fee (I didn't even realize before that PayPal charged me every time someone sent me a payment for something they had won.

Their Fee depends on the Total Amount Sent), that I had been Charged 25% of my Total Sales. This was under a 50% off day. If it had been under a regular bidding day I would have been charged even more. Also, to keep my Insertion Fees low, I started almost all my bids at .99 I don't understand how people make money off EBay this way with all the fees and charges. I might as well go ahead and open my own store. I will no longer be an EBay Seller, and I will no longer use PayPal.

This is a cautionary tale into how eBay treats their customers. eBay appears to be facilitating identify theft against their customers by setting up fraudulent user accounts on their site. Current eBay customers have their names and addresses used to set up a fraudulent account. eBay sets up the account but makes no effort to contact the true eBay customer. The fraudulent user sells items, incurs selling costs then leaves it to eBay to collect the selling cost from the identify theft victim. Once this identify theft occurs you, the legitimate eBay customer have to fight your way through eBay's customer service chain to try and fix a problem eBay created.

This is a description of my encounter with eBay. On 26 February 2010, I received a letter from I.C. System Inc., a collection agency. I immediately called the collection agency and after a lengthy somewhat heated discussion, they said the bill was for a software purchase. The only software I purchased from eBay was paid via a PayPal electronic transfer on Nov 16, 2009. PayPal shows the final transaction on Nov. 20, 2009.

I've never had to deal with a collection agency. After this one encounter, I can understand why the Federal Government had to implement controls on collection agencies. After my discussion with the collection agency I contacted PayPal who referred me to eBay. In my discussion with a series of eBay representatives, I was told there was another account that was using my Name and Address. They provided the account name to me and I was able to look up the account on eBay and found that the account was suspended. However, the account holder had apparently managed to sell one item, XP Professional software. This is the same type of software I had purchased two weeks earlier.

The software was supposed to arrive with some type of hardware to meet Microsoft reseller requirements. The software arrived by itself. I assume this is a violation of Microsoft's reseller policy and probably something that has been reported on eBay in the past.

Back to the story, it appears that the company or individual I purchased my software from on eBay used my name and address to set up an account and sell software on eBay. They probably took my information on the shipping address I provided them when I purchased my software. Just to get the software, I had to initiate eBay's complaint resolution process due to the lack of contact from the company and the late delivery. The individual I supposedly order the software from lived in WI while the software actually came from China. In fact, I was worried when the software arrived from China but this isn't where eBay said the seller resided on their web site. Probably that poor seller listed on the website was also a victim of identity theft.

eBay should not have set up a second account with my name and address but they did. They were even nice enough to let the individual who set up the fraudulent account have a different e-mail address so I would never know the account existed. eBay should have caught that my name and address were already associated with a different account with a different e-mail address during the account set up process. A simple e-mail to my legitimate eBay account or my legitimate e-mail address or a letter to my home address would have kept the fraudulent account from being opened. I believe this is the practice of many companies when a change is made to an account. In my discussion with eBay, they claimed they had security in place but I think it was only to protect eBay not their customers.

Anyway back to my story, I got passed from service rep to service rep, each one promising to get back to me or "personally" fix the problem. No eBay rep ever got back to me and no one has fixed this problem so far. When I told my wife I was waiting for a phone call, she patted me on the shoulder and told me "good luck with that". I should have listened to her. Finally, one service rep told me to formally submit a complaint via eBay's complaint webpage. I did that and was told they would get back to me in 24-36 hours with the latest being 72 hours. So five days later, I'm still waiting for a response from eBay. Time to call again, I call and I'm told they will fix the problem. Well that didn't happen. Instead, I receive an e-mail that told me I had to work through eBay's "Live Help". So I did that only to find out that the "Live Help" rep didn't seem to have any record of my complaint.

So, still no problem resolution and no response from eBay. Maybe I'll get a response, maybe I won't. Moral of the story, don't expect any help from eBay if they cause a problem that you have to fix. It is hard to put into an e-mail the totality of the phone calls and the "Keystone cops" customer support I received from eBay. I'm just putting this information in this system as a warning to folks to be careful in their dealings with eBay.

I've already contacted the three major credit companies to see if any other accounts were opened, I filed a identify theft report with my local police department. I filed a complaint with the Federal Trade Commission. I filled a complaint with the local BBB in San Jose. I even wrote the president of eBay yesterday. But I probably won't get much back.

So, all is said. And guess what, I was able to fix my computer without the software I ordered from eBay. The software is still sitting in the basement wrapped up in plastic. Hours of my time wasted from the collection agency, PayPal and eBay. Letters were written to a collection company and eBay. A request for my credit report was sent from the three major credit card companies. Primarily, this has been my time and worry. The amount of the charge is small. The treatment provided to me by eBay is probably indicative of their treatment to other customers.

Wednesday 3/3/2010 approx 14:43: I spoke with Shane who stated he cannot help but forwarded information to dept "that can help. " He also stated that I will hear from them in 24-48 hours by email or phone.

Thurs 3/4/2010: I got support satisfaction survey from eBay which I answered appropriately.Saturday 3/6/2010 11:39: I called support again, spoke with Mackenzie who actually transferred me to a real person in account security. I got Keith or Keive, not sure which is accurate. He investigated and transferred me to "Safe Harbor" dept. I was not transferred but Keith acted as a go-between for communication. Upon asking for physical address for legal dept., I was transferred to the "Safe Harbor" dept with Jason. Once again, I was told that it will be 24-48 hours.

I sell stuffed animals on eBay. I am listed as Power Seller and Top Rated Seller with a 100% perfect feedback account of 1,327. I had a woman, with only 3 feedback scores, do a Buy-It-Now on a single animal as well as a set. I was sure she made a mistake so before sending an invoice I asked if she realized what she did, then she said no. I told her to cancel her orders. After she did, she placed another order for another set. Her cancellation of bids didn't show so I called eBay and asked them what to do. I didn't want a new buyer to listed as a non-payer. I was told the seller has to do the cancellation and the buyer has to agree.

I filled out the form and she did the agreement form on two of the auctions. eBay refunded my selling commissions. She finally paid for one set. She also had her address messed up and PayPal wouldn't let me print a shipping label. I told her to correct her address, she claimed she did it, but I still couldn't print the label. I called PayPal and was told to use the post office to ship it. I did and got a delivery confirmation that the package was delivered 2 days later.

Two weeks later, she sent me a nasty email: "Hi Ruth! This is Nelda and I am emailing you to let you know that I never received my order and to please process my refund to my account because this has taken way too long and it was not what you have advertised and I am not interested to do business with you any more. I have ordered from someone else and I will also let eBay know about it."

I told her the tracking number of the package and told her that it was delivered. I told her to print the confirmation and ask her mail delivery person what happened to it. She then told me: "I really don't see why you have to write so rudely since all I am doing is asking you a question, and it was not a pleasure doing business with you. Goodbye! You are a very nasty and arrogant person. So unfortunate to have done deals with you and I will post his on eBay as well.Good bye! Keep my money cause you obviously need it more than I do!" She doesn't sound intelligent.

She went to eBay and gave me 3 negative feedback scores, feedback on the 2 sales that I was nice enough to cancel for her and the sale that I worked so hard to get to her! I called eBay today and was told that since I canceled the sales, not the buyer, she can leave feedback on a sale that didn't push through, even though an eBay employee told me a buyer can't cancel a sale, only the seller can.

She put me through to the resolution department. I was on the phone for over an hour while this person told me that the person that told me to cancel the sales was wrong, there is nothing that can be done, the 3 negative feedback scores stay on my previous 100% perfect feedback acct of 1329 before her 3 negative ones.

All the eBay employees are very limited English-speaking people, talking very fast and very hard to understand, after the long drawn out process of their know-it-all computer that doesn't know any thing. eBay used to be so friendly and easy to work with. How they can let a person with 3 feedback ruin my perfect feedback is beyond my comprehension! My perfect record is damaged and I can't revise the positive feedback I gave her earlier. If she didn't receive the package why didn't she ask PayPal for a refund?

I bought a water testing meter from a vender on eBay and when I got it, I realized it was junk. Inferior in design and construction, incapable of performing as stated. That was the beginning of my education. The seller, A "power seller", complained to eBay about the feedback and got them to remove my negative feedback even after the seller refused to reply about my defective merchandise complaint!

This seller is still selling defective, substandard water meters because the overwhelming majority of folks who buy one of those defective meters have no way of testing it and are assuming that it works! It is my belief that eBay is much more concerned with keeping their big sellers happy than they are about little buyers. The "buyer's protection plan" is actually a "seller's protection plan". I've been an eBay buyer and seller (very small) for years and I have seen it change over the years to how it is now. I no longer buy from eBay. My item was cancelled because eBay said it was a counterfeit. Ebay encouraged me to contact the company directly by emailing them. I feel an obligation to share with you what else eBay has encouraged myself and so many others to do. If you think eBay is taking action per your request to stop items listed violating your intellectual property rights, you should know they are. They got my account and I'm sure they try with many more. But did you know eBay is actually incenting hundreds of thousands of their own customers like me to resell the very items you are requesting them to remove, but how can this be?

If you have a PayPal account, you might remember getting an email Thursday, 10/22/09. If not, you can ask eBay about the email sent to every PayPal (an eBay company) member enticing us with a free $20 cash back for purchasing items for resale at eBay. This offer was for very specific "overseas" companies. The offer applied only to purchases at one of the following merchants: Graniph, FocalPrice, Milanoo, Dhgate, BestOfferBuy.com, MyCatwalk, Wiggle Time, Sasa, all well known for their fake, counterfeit and pirated products.

I'm a sucker for a free $20 so I used PayPal to buy a few things. I received the items followed by eBay's promised $20 cash back! This made me $20! Awesome, so now I use eBay to sell one of the items. So eBay is doing really well with this! And so did I, until eBay cancelled my account due to violating their VERO policy. Now, I'm no legal expert but I know when something is morally wrong and this is really a no-no on eBay's part. Everyone makes mistakes but I think eBay is purposefully doing the wrong thing here. What do you think?

I would never have bought something from overseas without PayPal giving me $20 and when the premise of the sites are to resell for profit on eBay, it should be okay since I was recommended by PayPal. I wouldn't want to be eBay when this information is given to court to decide. Everyone is being hurt, except eBay. I would love to bring all this evidence to court as well as offer up my testimony and help any VERO sue the bejesus out of these crooks!

eBay ended all my listings, 1025 of them, and refused to refund my fees ($350+). According to eBay, this was because I bought an item from someone who had previously left me negative feedback. There is evidently an eBay policy that prohibits this. By eBays own admission, this is an internal policy and is not published anywhere. So there is absolutely no way I could have known this. They say it is to prevent people from buying something just to leave negative feedback in return?

The problem is I never left a negative feedback! eBay said they don't care. Merely the act of buying something from someone who has left you negative feedback constitutes interfering with an auction and malicious intent. How can buying something in an auction and paying for it be interfering or malicious? Isn't that what eBay auctions are for?

Having tried to put an item on eBay to sell in about September last year, I wrote to eBay to note that I couldn't get to the point of selling. Firstly this was because of a problem with PayPal, which was resolved; however, this didn't help, and now my item was no longer visible on my items for sale let alone viewable by purchasers. I was told that my account had expired, which couldn't have been true due to the activity, but went through the inconvenience of re-enabling an active account. That made no difference, so I asked how to progress, and was told it was due to my account being expired due to a lack of activity and to go through the same process I completed a couple of days earlier.

I repeated this circular action several times before asking for some help that would progress this, and at that point I received radio silence. Having requested access to their customer service director or supervisor, there has been no response to any email. Your help would be greatly appreciated. There seems to be no way on their website to lodge a complaint. This has lost me money as well as taking up valuable time.

The eBay customer service number they don’t want you to have is 866-643-3720. Be sure to press 2 so you get a live person. I listed an ad on eBay to sell four used tires and rims as an auction item or sell now for $1500 for rims that alone would cost $2500 new. The ad clearly stated used tires and rims. No returns or refunds. All intended buyers had the option of asking the seller questions, but this customer in particular had no questions, but immediately purchased the used tires and rims. The buyer received the used tires and rims and stated that although he looked at the six pictures available on the ad, read the particulars on the ad, he didn’t think that what he received was what he paid for. Despite the fact that the add clearly stated used and no returns or refunds, eBay sided with the buyer and we were forced to return all money involved which also meant we lost $250 of our own money because the initial shipping and handling costs were greater than the $250 in which we asked the buyer to pay for the shipping and handling.

We attempted almost everyday to speak with a live person in the resolution center at eBay to discuss the matter, but eBay would not send us a telephone number and instead continued to send us information by email. The day they finally made contact with me in person, it was already decided that they had reimbursed the buyer for the sale of the tires and that we needed to reimburse eBay. eBay didn’t give us the opportunity to appeal this matter at all. When I asked to speak with a manager or supervisor, I was told I couldn’t speak with anyone else. I do think that if someone received something other than what the add states, there should be a refund; but this was not the case. eBay didn’t try to assist me at all with this matter except to inform me that I needed to return the money to PayPal. In my opinion this was poor business. Thanks eBay!

"eBay Buyer Protection" should be "eBay Buyer Beware". They will not cover any items under $250 that the post office says it has delivered! So, understand that you, the buyer, not the seller, are assuming the risk for items under $250. Some "Buyer Protection." eBay has no real "Buyer Protection", more like seller protection. eBay’s "Buyer Protection" is misleading small buyers in the worse way. The post office "tracking" is just a gotcha when it comes down to it. Of course the USPS will say they delivered it if they lost it at the final stage. It's just their word against the buyers. And the buyer loses every time under eBay’s "Buyer Protection" for items under $250. As for items over $250? Should I trust eBay? That's a joke, right? I lost $37 that I paid for a camera part that never arrived.

In May 2009, I was scammed on an eBay transaction where I posted a $6,250.00 cushion-cut diamond solitaire ring. I received a message on eBay from **@gmail.com stating she wanted the ring. I was brought from the eBay world to my personal email after the member asked me to email her personal email because of her busy schedule, which I did.

After a few emails, I received what I thought was a notification from PayPal saying that the money had been posted to my PayPal account but was on hold until I could provide a tracking number to verify shipment. It never crossed my mind that I had received a fake email. I shipped the ring to Brooklyn, NY to who I assumed to be Vanessa ** at 1346 East 2nd Street, Brooklyn, NY 11230.

She requested the ring be shipped overnight by 10:30 am via FedEx. I did this! Not long after, I thought the ring had been delivered. I started calling PayPal to see why the payment had not been released to my account, because I had done everything I needed to do. PayPal had even sent me an email saying that shipment had been verified. I thought it was all true. PayPal informed me that I was scammed by the buyer.

I called FedEx only to find out the package was already delivered and it was too late. They said they couldn't do anything else about the matter, but they did have the driver verify that the package was delivered and signed for!

After months of stressing and crying over this matter, I finally gave up, so to say. I have spoke with Secret Service Agent Joseph ** in New York who told me they were still investigating the matter. That was two months ago and haven't heard anything else. I noticed this email from RockYou today saying they tried to notify me in December 2009 regarding my account being under investigation because of someone tampering with it.

I am very concerned about this matter. Please help me, because this could be exactly how this happened to me. And now, I am out tons of money. I posted my ring on eBay, because I was in a huge financial bind. I am a single mother of three children and am currently in RN school hoping to graduate in May this year. Please help me! I look forward to hearing from you soon.

I was sold this fake club on eBay and eBay and PayPal will do nothing to help me get my money back or stop this guy from ripping off others: New Callaway FT-iQ Driver 9 Regular with head cover. This seller, and eBay are allowing people to get ripped off because they are selling counterfeit golf equipment and eBay knows it but does nothing about it.

I purchased a cell phone from a member. The phone was defective. On January 4th, I returned the phone to Plano Texas, and the seller agreed to replace it. I found out that the member wasn't Weston **. Instead, it was Stephen ** in Euclid Ohio. This is definitely a case of misrepresentation of identity. I have confirmation that the phone was received on January 8. I paid $200.00 for the phone and an additional $50.00 to have it repaired, but the cell phone was beyond repair. Please help!

How does it feel to be ripped off by an Ebay seller, then find that such is supported by Ebay's brain dead policies? My story is about one of the monoliths of online business called Ebay. You know, that little company that is now operating in 30 countries. This little tale is indeed a warning to others that use them and what type of response one can expect when problems arise.

Mine is over the attempted purchase of a car on Ebay Motors. In December, I won an auction for a car in New York with what turned out to be a thief by the name of Anthony D. I made a $300 deposit to secure the deal, then set up an Escrow, and sent the funds off to California to secure the deal. Booked a truck and paid $700 in shipping costs to get the car to Fort Lauderdale and that is where the ** hit the fan.

He admitted to the trucking company that the car would not start, which he, of course, has neglected to mention in his listing, e-mails and phone call with me. Well, not surprisingly, the company refused to accept a car that does not start on its own. He gets back to me saying that he can't ship the car due to this, so I tell him that he has to fix it because he did not disclose that simple but very critical issue in his contract.

Instead, he simply refuses to ship rather than fix the problem and subsequently to date has refused to respond to every message sent to him. I even relented so as to not lose all the time I had invested in this deal, to offer to pay for the repairs, not something I should have to do but it appeared to be the lesser of the two evils, and to that offer, I got a dead silence!

If you have any familiarity with Ebay, you will be aware that their site is loaded with all the statements of buyer protection, hence, I think that it should be no problem to get this deposit refunded which the little thief had stolen from me. It was bad enough that by this time I have a good 40 hours invested in this project, now, I have a jerk that thinks he should get paid $300 for being a liar. I submitted all the documents to Ebay, as requested. However, they refused my claim just this week.

To say the least, I was quite shocked since I have a mountain of evidence like contracts, documents, payments etc that show I have fulfilled my end of the contract in spades. Guess why Ebay told me I was out of luck. I was refused because I do not live in the mighty United States of America. So what this completely brain dead policy says is that it is perfectly okay that they harbor thieves as long as they only steal from foreigners! Now, of course you have to dig deep to find this policy. It is hardly something that one would discover under normal investigation especially since I thought I was dealing with a company of some repute rather than a corporate **. FYI, I have used Ebay for over six years with sixty five transactions and 100% rating and this is the response I get for being a long term customer that has fed thousands of dollars through his account at Ebay.

The final communication from them said that they are sorry that I am frustrated, to which I replied that if they had a capacity to understand the English language, they might realize I am not frustrated at all. What I am is furious that I found out the company that is supposed to be protecting me as a good member has policies that harbor thieves with impunity. I am utterly amazed at this policy coming from a company that operates in 30 countries. You would not think that they would need to have the concept of Globalization explained to them and how all customers should receive equal levels of service and protection regardless to where they happen to reside.

What this say is that if you don't live in the U.S, then, you are indeed a second class customer and they could care less if one of our good thieves gives you a screwing over. I have long observed that many sellers on Ebay give the impression that all the dishonest people reside outside of the USA, and that everyone within the borders is an honest Joe. Needless to say, I find the concept more than a little bit ridiculous and if you reside outside the USA, I am certain you have experienced this as well.

Well the final summary is rather simple for me. I have found out the hard way that Ebay has in fact zero integrity and most certainly, protection that is suspect at best and in general is not to be trusted any further than you can throw them. This little event has indeed raised facts that I was not aware of over these many years of use. Needless to say, the damage is huge and quite irreparable now that I know the real score.

As I told them, you can ** me out of $300, but that is nothing compare to what I will cost them as I move my business to other online companies that don't have the corporate morals of a **. To me, this is a black and white issue, no gray area here. If your policies support thieves and people with zero integrity that break their contracts, then you are just as bad. In fact, Ebay is worse since it is providing the facility for such crooked members to operate in.

When they support members in such activities as this, there is no question in my mind that this Anthony D. has and will continue to fraud others through this medium. It is certainly not something I expected or will tolerate in those that I feed. It still utterly amazes me how such a large global corporation can be so completely clueless when it comes with such offensive policies that fly in the face of what any honest ethical organization should represent.

Let's be aware that what I was doing was not weird or unusual. It is not exactly uncommon for someone from outside the US to go looking for cars there. This one was a collector's item, hence, the most available selection of such units is in the US. But all foreign buyers must be aware that they are just lemmings being led to the slaughter in the eyes of the brilliant policy makers behind Ebay!

I have been an eBay user for years. I have had good experiences with wonderful buyers until last week. They say there's one in every crowd. Well, I should get the prize for getting the biggest eBay scammer out there. I am sickened that eBay has now changed their policies to accommodate scammers and thieves. Changing the feedback system to only accommodate scamming buyers is a discriminatory act as far as I am concerned. eBay allows scamming buyers to post negative comments affecting scores but does not allow sellers to respond with comment before negative feedback has destroyed a perfect record.

I have several clients that have stopped utilizing eBay for this reason. There seems to be no way to contact eBay and have a live conversation. Most likely because those with legitimate complaints would clog the phone lines. eBay baffles sellers with changes to their policies promising savings but ultimately costs sellers money in the long run by demanding sellers to cater to thieves. When a seller describes an item with all of it's flaws, lists it as a non-refundable item, shows photos of the item and states that questions should be asked prior to bed being made and a buyer chooses to purchase item knowing its condition without contacting seller. eBay should not allow buyer to leave negative feedback.

A person with perfectly good feedback can have their exposure destroyed because a buyer deems shipping unreasonable when in fact, the U.S. postal service fees continue to climb. It's all about the scamming buyer wanting something for nothing and extorting it out of the seller in exchange for not getting a negative feedback mark. This is ridiculous. Unfortunately, I have been in shops where I have overheard buyers laughing about how they have figured out how to get something for nothing by complaining that they are a "victim" to eBay.

As I stated, I was okay with eBay until a scamming buyer purchased an item that I listed in great detail. They decided they didn't like that, the item had a flaw as described in listing and in pictures. Against my own policy but to keep the peace, I offered full refund upon receiving item back, buyer declined to send item back. I offered partial refund, buyer declined again and demanded more money. I declined requesting them to send item back for refund. Buyer filed negative feedback and then proceeded to e-mail nasty e-mails. I contacted eBay stating that I requested buyer to not contact me again as I viewed their e-mails as harassment.

I have yet to hear from eBay in regards to this. Then, I get a notice saying I violated policy by leaving a positive feedback with a Buyer Beware message (I was hoping to warn others about the scam this buyer was pulling). When I looked back on buyers feedback, they had done the same to other people, 9 times! Not only do I get a notice but the buyer gets away with filing positive / negative feedback. Go figure! I then receive a notice that my shipping fees are too high.

I charge what the U.S. postal service charges and not a penny more! If I have over calculated, buyer receives a credit the very moment I print the label and my account reflects the few credits that I have issued. I then send buyer a notice of credit and this is before they even receive the item.

As far as I'm concerned, eBay lacks integrity and honor. It saddens me that what once was a good thing has turned into a horrible waste of energy. Shame on eBay for their flawed policies. At the very least, they should offer a neutral feedback option for sellers. Shame on eBay for blocking eBayers from speaking with a live service rep and shame on eBay for being greedy. I have great hopes that someone will create another auction site with integrity and honor.

I have paid my seller fees before they are due, I have responded to my buyers in a timely manner and I ship same day when item is paid. I have fabulous feedback and it frosts me that I'm penalized because one crummy scamming buyer makes a living off of ripping people off. This buyer has other complaints against them but eBay has chosen not to do anything. Shame on eBay! Owning a small 2nd hand business is my livelihood. The economic damage this has caused is huge! My clients purchase items from me to sell on eBay. The majority of my clients have told me that they no longer sell on eBay because of the discriminatory nature of the scoring and feedback system. One of my clients fed his family and paid his rent with what he made on eBay. He had perfect scores until a scammer got a hold of him. One lousy negative feedback and the guy couldn't recover. He threw in the towel.

I have purchased several items on eBay from one seller. Prior to purchase, I had correspondence with the seller. The seller indicated the shipping expense would be free, plus buy one item and get the second item free. I purchased six items for total of $11.94. The seller has added a charge of $29.94 to the statement; plus there was no discount provided to get free items.

I have called eBay 3 times and each time I called, there were no documentation by eBay. I called to file purchase/billing compliant. The last two times eBay has sent me an email confirming call but no information has been documented. The same seller has an item I'm willing to purchase for (Price: $7.99 - free shipping). I have offered eBay and the seller, if I purchase one addition, I would not expect any free items but request previous order be included with new item for shipping.

eBay or the seller has not adjusted the account. I have asked customer service for American contact. Per guideline, no corporate office is available to accept calls or complaints. Other challenge is the seller is in Hong Kong. I requested eBay to assist in potential language barrier but the response from eBay: they can not assist with concerns. I received an email today from seller, shipping is free but selling price of merchandise would now be $5.00 more per item (free shipping but selling price is increases 200%+).

On January 13, 2010, I bought an Acrobat 9 through eBay and paid through PayPal. When the item arrived, I tried to load it onto my computer but couldn't. I tried it on other computers with the same result--the item is defective. I found that the item was shipped from China, and I have emailed the seller several times but have not received a response. I contacted both eBay and Paypal without any resolution to the problem. I have mailed the item back to the seller with a request for the $79.99 that I paid them.

Please could you give me your opinion of something that affects thousands of people in this country? I have just bought something listed on the UK eBay site, only to find it is a non-working fake. Ebay will not help with a refund from the seller, as a few days after I bought the item eBay realized the seller was committing fraud, and threw him off the site. I can just about understand that, and realize that I must take some responsibility, but what really annoys me is this. Ebay knows that a fraud has been committed, and they know that they profited from it in the form of listing fees, final value fees and Paypal payment fees, all of which came out of the money I sent for the fake item.

Ebay refuses to repay to me the money they "earned" from the fraudulent transaction. Is that fair? To me, it looks like they are making a profit from an illegal act, which must itself be illegal. I am just one person who has lost 43 pounds on this transaction. Ebay earned about 5 pounds from my misfortune. However, this sort of fraud goes on all the time, so eBay's earnings from illegal transactions could well amount to hundreds of thousands in the UK and millions worldwide. This huge and powerful company that is growing exponentially, cares only for its profits. It seems to have no qualms about profiting from fraud.

I've been buying and selling on eBay for 10 years with a 100% perfect feedback record, everything from guitars to cars. Recently, I began selling some Tiffany pens and Citizen watches, and they froze my account from selling. When I spoke to them, they said I needed a 'longer history'. What exactly does that mean? Ten years with a perfect record isn't long enough?
