In February 2009, I began looking to refinance my mortgage. I was comparing rates and contacted a Bank of America representative named Raymond **. I had to have my appraisal done through Bank of America as this was their "policy." I was not concerned, because the value of homes in my area was good and my husband and I made a lot of renovations to our home.
The appraisal took place in March 2009. I was shocked when the appraisal came back low, leaving me will less than 20% of equity and causing me to pay PMI each month. I was concerned about this and spoke with Ray about it. He said it was due to the housing market being down at the time. When I asked for a copy of my appraisal (which I paid for), he refused. He told me he could not furnish me with a copy of it and that I could review it in his office if I would like. This to me was completely unacceptable, unprofessional, and a scam.
I was so far along through the refinance process that I just decided I would pay down the loan as quickly as possible to have the PMI removed. Mr. Raymond confirmed that once my equity reached 20% of the loan, the PMI should stop automatically but that I should call to make sure this took place.
Half way through my closing, when signing the huge stack of papers that they provide, the woman from the title company explained to me that the appraisal company which appraised my home is owned by Bank of America. My husband and I were disgusted by this. This confirmed our suspicion that our home was deliberately under-appraised by Bank of America, so they could make additional money off us by forcing us to pay a monthly PMI. Again, we agreed we would pay down the loan as soon as we could to remove the PMI.
We reached this goal in February 2010. I attached a note with this payment, requesting the PMI be stopped. I checked my account online each day to see if the payment had been adjusted. On February 14, 2010, I sent an email making the same request. Again, I checked my account daily waiting for my payment to be adjusted.
On February 22, 2010, I called a representative. She told me she would submit my request. Later that day, I received an electronic response to my email saying they would submit my request to the escrow department. I continued to check my account daily. On March 4, 2010, I called and expressed my concerns with another representative. He was looking into it and placed me on hold. I was conveniently disconnected.
I called back and spoke to a man named Bryan. He tried telling me the PMI had already been taken off my account. When I asked him to tell me the monthly payment amount, he said $2,589. I informed him that it's what I've always been paying and asked how he can tell me the PMI has been removed. He placed me on hold. A few minutes later, Danielle answered. I explained my entire situation to her. She of course said I have to wait to receive a letter from Bank of America.
On February 5, 2010, I was disgusted when I received my letter. It states that the current value of my property must be equal to or greater than the original value of my property at the time of the loan. It further states a COV (certificate of value) is required to determine if the current value of my property is sufficient to meet this requirement. Then I am asked to enclose a check in the amount of $130.00 and am advised that additional fees may apply.
I was never advised that I would incur additional fees in order to have the insurance removed. I maintain an excellent credit rating, and I am being treated unfairly for no other reason than to pad Bank of America's pockets!
I want the PMI removed from my loan without obtaining or paying for a COV. I sent an email to Ray ** and the Bank of America executives on March 9, 2010. Emails have gone back and forth between Mr. S and my self. However, it seems he still does not fully understand the problem. I send a second email to the executives on March 24, 2010, asking the status of my request. I have received no response from any of them.

They changed my mortgage loan without my written authorization. I cannot afford my new payment. I could end up losing my home and no place to live.

I am currently pursuing a short sale with Bank of America. Certain circumstances landed me in this situation. It all started February of 2008 when I put my property on the market. I got my first offer in the fall of 2008. I actually got five of them. I was told by BoA that they had all the information that they needed from me (financials, hardship letter, etc). It was in Phase II of the short sale proceedings. They would come out and do a BPO on the property and should have an answer to the short sale request within two months.
February 2009 came and we were told it was now in the final phase with the short sale negotiators and the lender. When calling to inquire about the progress a week later, I was told that my file was nowhere to be found; to resubmit all of the information and purchase agreement. I would need to start over. The best part is we were told that the person we were dealing with no longer worked with the company and most likely never touched my file. I was then advised that since I am not late on my payments that they really couldn't approve a short sale. I asked if I should stop making payments and was told that as long as I am current on my account, Bank of America doesn't see a need to help me with a short sale and would most likely not be considered for one. So I stopped making payments.
Finally, in June of 2009, after two complaints were filed with the BBB (which never got resolved) and several attempts to find out what was happening with my pending short sale, it was escalated to their "consumer advocate group. " The sale was approved; however, the buyer walked several months prior as he had been waiting for an answer for over six months!
In July, a new purchase agreement was submitted and processed in a few weeks, but that did not go through because there was a discrepancy over $2500.At this point, I am at a loss and don't know what to do. I begin to file the paperwork to be approved for a deed in lieu of foreclosure. I was asked to get the lien released from my home equity line of credit. My HELOC lender asked to have something in writing from Bank of America. I expressed this to the Deed in Lieu negotiator seven different times (messages, email, voice mail, etc.) and got no response. When I called a week or so later to check on the status, I was told it was denied because I failed to get my lien released from my HELOC. Papers were served to me for foreclosure in November of 2009. I filed a complaint with the comptrollers office. The foreclosure was postponed until February of 2010.
October of 2009 a new purchase agreement was submitted for yet another attempt at a short sale (six total purchase agreements). I was told that due to my pending complaint with the comptrollers office, that my file was passed along to the "office of the president" at Bank of America and should be handled expediently. Another customer advocate was working with my file to ensure that it was handled properly.
December of 2009, I was told that my file is now being transitioned over to Titanium Solutions (a third-party company) to handle my short sale. They came out the very next day and did a BPO on the property. They received all of the paperwork and submitted it. It is with the lender waiting for an answer if approved or not. I have been waiting for an answer since the first week of February 2010.
This is completely ridiculous. I have contacted a lawyer and was told that I definitely have a case against Bank of America for the mishandling and lying that was done, but unfortunately, I do not have the finances to sue them. I am stuck in a mess that has been going on for over two years! Help!

Last year, I contacted BoA about delaying 6 payments on my mortgage due to a pending divorce. I was told they could not do that any longer and to do a modification which I started in April. I have submitted my paperwork 4 times, all the times paperwork was lost or misplaced. I have been told approved then told not approved. I was told payment was reduced by 50% to "I'm sorry, you don't qualify at this time" to "oh Mr. **, you must be behind on your payments to be considered for this". It has now been a year since I started this and my hardship does qualify for help for sure.
I have been going through a divorce, been laid off from my job and have a daughter who has gone to college this year plus I have elderly parents who I am taking care of physically. Bank of America has been of zero help to me. I have my house on the market and has been shown 37 times with zero offers so far. So now I am trying to go through a short sale and now Bank of America is giving me a hard time on this. I need help.

In February, I called customer service to move my auto draft from 3/1/10 to 3/15/10. The representative advised me he would cancel both payments and deduct my entire payment as 1 payment on 3/15/10. On Monday 3/15, I decided to check my checking account and discovered only 1/2 of my mortgage payment had been deducted, so I called customer service again and spoke to another representative. The representative advised that there was no record of a payment being drafted for the full amount from my account. I advised him I did not want my mortgage payment to be late and explained the previous conversation from February.
I called customer service again and requested a Supervisor, someone by the name of Ms D. stated she would submit a request to refund 1,352.00 back to my checking account and it could be done by Monday March 22. I advised her that would not work as I did not have any money and had another bill that was due to be paid, Ms D. stated she would try and expedite my request however it could be Monday at the latest. She stated she needed to see a bank statement showing the payment had cleared my account and was paid by my bank. I printed a copy of my checking account transactions and immediately faxed them to her and the payment processing department while still on the phone. Ms D. confirmed she received the documents and would again expedite my request.
On Monday March 22, I checked my checking account to discover Bank of America had not returned the extra funds they withdrew, so again I called customer service and was told my request was in process. I called Bank of America Mortgage customer service again on Wednesday March 24 and requested to speak to a Manager. I was told the manager was not in and a message would be left for her to contact me. At 4:45 pm CST, I called BOA customer service again and request a Manager, there were 2 representatives pretending to be Supervisors who stated they would complete my request immediately. I advised them this was my 4th call trying to resolve this issue and that I intended to file a formal complaint. I was assured by Supervisor George in the payment processing dept that he was going to overnight a check to my home address and that since it was after 5pm PST the payment would go out on Thursday and I would have the funds by Friday. George assured me this was the fastest way to receive my refund instead of reversing the payment back into my checking account.
Today is Saturday March 27. I have not receive a phone call nor have I received the overpayment from my account. May times during the various phone calls to BOA Mortgage customer service, I asked for someone higher up mailing address or a phone number for the complaint dept only to be given incorrect information. It is unacceptable for a corporation of this size not to provide access for formal complaints. I have been charged overdraft payment by my bank as well as I had to borrow money to pay one of my bills and purchase gas and food.

I have a mortgage with Bank of America, and I was three months behind in payment ($1,800). I applied for the Home Retention Program. I received a six month forbearance in June 2009. For six months, I paid half my note, and I was under the impression that I would receive a loan modification. In January, I started calling Bank of America to check my status. I was told that my account was in review. I received a FedEx mail saying that my account is going into default, and that I owed $5,698.
I called and spoke with a representative, who gave me the runaround. I told him that I thought the Home Retention Program was a scam, and Bank of America's practices are criminal in nature. I feel that I was not told the trust in lending, and that now I am in a worse situation than I was in the beginning. Bank Of America has not offered me a viable option to keeping my home. Refinancing is an option, which I thought would be offered to me. I don't think President Obama's Plan for America's homeowners was meant to rob Americans of their homes. This is madness! Where is the nail out for the American people? I am near foreclosure on my home without any viable options for a release.

BOA bought Countrywide, my original loan. They decided I had to get wind insurance. I told them no. That was not part of my deal with Countrywide. They purchased it anyway for $14,000 a year and backdated it five months (illegal). This is something that usually costs $2,000. I got the policy in the mail, marked a big X on it and sent it back telling them to cancel. I did not want wind insurance. I haven't heard anything for six months-- no bill, no call. Then I find out they have added it to my escrow account. I paid the bill and do not want to add $2000 a month onto my mortgage payment. BOA is a thief. I know they got kickbacks from this and now I will lose my house. They will have to auction it off and lose way more than $14,000.

Last April 2009, I began the process to modify my mortgage with BOA. My mortgage debt ratio to income is 65% and I need help. This was denied in November 2009. I received a letter that said, "We recently received your request for financial assistance. We regret to inform you that there are no available workout options based on the financial information that was provided." I am current on my mortgage payments and have gotten a bad credit score because of this. Other debts, medical etc. have gone to collections so I can't go to another financial place for a refinance.
BOA did offer a refinance that would cost me $5,000 and reduce my payments by $117. It's not worth it! I can't sell my home in the current market and frankly I like living here. My current mortgage payment is $1,300 and the income from my two jobs is $2,200 net. My health insurance premium is $488 which leaves me $400 left over to pay everything else. The stress is really getting to me. Thank you if there is anything you can do to help.

I have been waiting on my workout with the department at Countrywide, and when Bank of America took over, I updated information and had still been waiting since that time. I all of a sudden get a letter with intent to accelerate my mortgage due to me being behind. And when I explained that I had been paying what the mortgage department told me to pay while I was still in the work out program, I was given the run around as to what happened with the proper codes being taken off my account which caused my loan to accelerate.
I also explained that this only happened when I requested the person in charge of my account to look at it and get back to me as to why this was taking so long, and that I haven't heard anything in over seven months. It seems like they are so behind and if you call them and request them to do their jobs, they just say, "Let's deny the people that's rushing us and foreclose on them to keep them off our backs." I was told by the supervisor that I need to resubmit everything all over again, and as of right now, my loan has been accelerated and I need to come up with the money as soon as possible!

The current raid on law firms representing people in modification is a way to deflect the press from reporting what is really going on, which is the abusive modification process that is taking place at Bank of America and other too big to fail banks. Let's face it, the elephant in the room is not the American Dream concerning health care, but the American nightmare concerning the loan modification process. It is outrageous, considering that they have received a bail out from the American Tax Payer, who is also the average American Home Owner.
After receiving a bail out in the billions from the American people, these banks have the audacity to harass, delay and humiliate us during the loan modification process called HAMP. How long do these banks think that the American people will tolerate this? One of the Bank of America representatives even went as far as telling me that the government cannot tell them what to do. I found this strange, because I never mentioned the government with the Bank of America representative. So, I cannot help but feel that Bank of America is bitter and is taking it out on those of us seeking a loan modification. It is also readily apparent that Bank of America feels that they only have to meet their obligation to the government by considering a loan modification with zero accountability. It is time that we make Bank of America accountable!
Bank of America knows very well that the average homeowner requesting a modification does not have the funds to represent themselves legally. So, the FBI raiding one of the largest and most reputable law firms will only serve these banks’ potential agenda, an agenda that might be to scare any law firms from representing the people. This current action by the FBI is not the solution, but a symptom of the overall problem. It is also blurring the lines in regards to who the real bad guys are. It will also further delay the process of reputable law firms like United Law Group from filing legitimate law suits. In retrospect, United Law Group is not only helping me represent myself in this law suit, but every American who is going through the loan modification process.
So, please, help me and United Law Group send a message to Bank of America which states that we will no longer tolerate their potentially irregular, fraudulent and abusive business practices. In the end, the American tax payer did not fail to deliver the Bank of America bail out in record time, but Bank of America failed to deliver the American Tax Payer's bail out in the form of a loan modification. It reminds me of that song by John Lennon and George Harrison titled "Piggies" I invite you to listen to this song on YouTube and see if it appropriately fits.

We were with Country Wide for our mortgage until Bank of America bought them out. When that happened, our account was in disarray. We were behind in our payments, but at the end of 2009 had everything caught up. We made a payment that B of A "never received", so we made another payment over the phone. Again, we were told that everything was fine. The representative that we talked to in January said that any late fees or additional charges would be credited back to us. In February, I received a call that we were past due again. I had to spend over an hour on the phone and talk to 2 supervisors to get this mess straightened out. Today, 3/25/10, they called again saying that we owed $150 still.
After speaking with 3 people, I was told that someone had "miscalculated" the charges and the balance due was $150. I told them to send me a complete transaction record before I would pay any fees. They said that they could do that, but it would take a week to process and I could be charged a late fee in the meantime. I am at my wits end and want to re-finance, but they have dinged my credit and haven't made any adjustments to the report (as promised). Consequence is that my credit report is being damaged as well as the emotional strain it has been. I have spent countless hours on the phone, speaking with multiple representatives and having to repeat the story to every one of them.

I am so disappointed in the lack of return calls, correspondents that we have received from BOA. In July of 2009 my husband, Clint, called and asked for a reaffirmation after he was being laid off from his place of employment in March. We signed and returned all paper work to BOA in July of 2009 and made one payment of the new amount of $853.34 each month. After the first payment of $853.34, when our statement came, it read that we needed to pay the amount of $983.31, so we did. I had my husband call and ask why our payments were not still the $853.34 amount that we were told we could begin making.
He was told it was due to our bankruptcy. We made several calls and BOA told our lawyer handling our bankruptcy that we were 5 months behind. We have never been 5 months behind. The only time we got behind was during our bankruptcy. We did not receive a bill from BOA and we were told it was due to our bankruptcy. Nine months later now, we are told we cannot close on the agreed payment of $853.34 due to we need to send in a statement from the unemployment stating Clint will remain receiving benefits for nine more months.
We sent in what was required over nine months ago. It should not have took nine months for BOA to get this completed. We should not be getting conflicting information from BOA. This needs to be closed, so we can carry on paying on our home as we agreed. If BOA had done their job correctly 9 months ago, we would not be writing to you. We need this resolved.

On March 25th 2010 at about 1100 hours, I called Bank of America at 1-800 and spoke with "Barbara" about information I needed for a loan modification. She transferred me to "Louis" who again requested my account information and security to discuss a loan modification. After a few minutes, he advised that I would have to speak with the Loan Default Prevention Unit. Louis transferred me and I was placed on hold for 15 minutes until an automated message apologized and disconnected me.
I called that number back 1-800 and at this time I spoke with "Mike," who again asked for my account number and security information. After another few minutes he advised that he had to transfer me to another Department. I was placed on hold and after about another 15 minutes, "Juan" answered the phone and asked again for my account information and security. I politely asked Juan if I was at the right Department because of the previous contacts I made today going back about 45 minutes at this time. Juan repeatedly asked for my account information and security without answering my question, and I again tried to make sure I was at the right Department before giving out my personal information to the Fourth Bank of America operator.
At this time, I asked for a supervisor and Juan refused three times unless I gave him my account number and last name. I advised him that I just wanted to speak to a supervisor (I felt uncomfortable giving my personal information to Juan because of his attitude). He placed me on hold for about 12 minutes and picked up the phone and changed his name to Michael asking for my account information and security. When I told him that I knew that it was Juan he placed me on hold and a Gina ** picked up about 7 minutes later.
I then complained that since I don't know who I am talking to at this point, I just wanted a complaint procedure form. I also wanted Gina to review the tapes and find out why Juan was so rude and trying to change his identity over the phone. She tried to help but advised that she could not review Juan's tapes. The entire process of trying to get a loan modification through Bank of America is criminal. I had all the information they needed and they roadblocked every avenue I tried to get through. Something has to be done about this. I am helpless.

I am writing this letter in hopes that I can get some type of help so that I can get my mortgage back on line and get my new mortgage company, Bank of America, to take responsibility for the accounts that they have assumed from Taylor Bean and Whitaker. I want them to quit making the consumer pay for things that they are not responsible for and quit harassing the consumer to try and bulldog them into paying for a mistake that was not in their control. I am that consumer and I am being harassed by Bank of America on a regular basis due to the TB&W scandal.
My home loan was being serviced by TB&W prior to the 5th of August 2009 when they were closed down by the Feds for fraud. I was not aware at the time that my mortgage had been transferred to Bank of America and realized it later in September 2009 when I went online and could not get any information from the online services that TB&W used to offer.
I called TB&W and was jerked around and basically was told to contact BOA--and that they were my servicing mortgage company now. I called BOA and was told to keep sending my normal payments to BOA in the amount of $1,088.00, so I did just that. The next month, I received a letter stating that my payments were behind so I called BOA and explained to them that I was not behind in my payments and that BOA needed to get my money from TB&W in order to update my account with BOA.
The BOA representative told me not to worry that when TB&W transferred over my account to BOA, my account would be updated and as long as TB&W was going through their bankruptcy, my account would not be reported to the credit bureau as delinquent. BOA has since stopped reporting my account to the credit bureaus which consequently has caused me to not be able to refinance my mortgage causing much stress to myself and my family.
BOA has sent me numerous letters of lateness saying that my account is in serious delinquency and that I needed to send more money to cover the delinquency. BOA is also charging me late charges causing my payment to increase from $1,088.00 to $1,396.00 saying that my escrow account is in the negative and that I need to pay it up in order for them to report it to the credit bureau. I told them that they need to get the money from TB&W and quit harassing me for extra money. Even after sending them verification of proof of all of my payments that were paid out to TB&W, BOA continues to send me letters of lateness.
Recently, I received a letter from BOA stating that my account was being placed in serious default and that I needed to send BOA $2,475.31 by 18 February 2010 in order to bring my account up to reinstatement. Otherwise, my loan would be in default and my mortgage payments would be accelerated with the full amount remaining accelerated and becoming due and payable in full--and foreclosure proceedings would be initiated.
Also, I had someone come by my house and harass me by taking pictures of my property after I asked them not to be taking pictures of my property. He just ignored me and kept taking pictures just to aggravate me. I was forced to call the police on him because I was not aware who he was or what he was doing because he did not identify himself.
I am being harassed by BOA for things that are not within my control. I have made my monthly mortgage payments and BOA needs to get those funds from TB&W. My mortgage payment went up from $1,088.00 to $1,291.52 in order to cover TB&W for not allowing enough money to be deducted on a monthly basis to cover taxes and insurance. And now that TB&W has been seized, I am being punished and harassed by BOA to try and make me pay for penalties and charges that I do not owe. BOA needs to get all my payments and apply them to my account and then BOA needs to update the three credit bureaus so I can get my mortgage refinanced with a new mortgage company. BOA is breaking the law by not reporting my accounts to the credit bureaus and they do not care.
I would like to know if I can force them report to the three credit bureaus and make them do their job. I am caught between a rock and a hard place. The mortgage mess with TB&W and BOA is causing not only me but hundreds of mortgage owners nightmares not knowing if we will loose our properties or not. The harassing letters only adds to our frustrations. If you can help me to fight back, please do. I have sent verification of all payments to BOA and have been promised that they were going to get my money from TB&W, but they continue to do nothing but harass and threaten. I recently had a hail storm damage my roof and other items. Bank of America requires you to endorse the insurance check and mail it to them, even though some of the items damaged are personal, the claims department cannot tell you how you can receive that money for your personal items. Bank of America only takes customer complaints up to the first line supervisor. I was told no upper level manager takes complaints.
If anyone is considering using Bank of America for any mortgage issues, run the other way stay local if you’re smart. I personally made a huge mistake moving my mortgage from my local bank to save a couple of bucks, it’s not worth it! I told the Bank of America supervisor that I was going to shop for a different mortgage company and she said, "That’s fine."

BOA reported I was 30 days late in paying my mortgage. I contacted their office to change the bank account on file to make my payment within the deadline. Customer service told me that I didn't need to do anything else. I was on a biweekly payment plan. BOA took the partial payment and failed to notify me that I was taken out of the program because of nonpayment. I was contacted a month later by phone and mail that I was behind on my mortgage. I paid the mortgage as well as a late fee. I asked why I wasn't told that I was out of the automatic payment plan when I contacted their office last month. The rep had no answer for me. I was told that in order to be put back in the program, I would be charged a $4 processing fee for biweekly payments. Also, if I made biweekly payments, I would have to notify their office and indicate what the payment is for.
My payments were made on the 1st and 15th of the month. I told them that I would make one payment monthly and keep my $4 processing fee. I was told that my payment should be made by the 15th of the month. Otherwise, I would be charged late fees. I was told in order to dispute the negative report, I should send a copy of my account so that it could be reviewed for any returned check info. I sent the information and received a form letter stating that their decision wouldn't change, because I had made a partial payment in October. I also told them that I had attempted to make an extra payment in 12/09 at a local branch and they couldn't find my account information. I had given them the payment stub with the account information but they couldn't locate it. I told customer service about this as well. They stated that they couldn't understand why that happened. In closing, I would like the negative report removed from my credit since I did everything that was asked.

I had a mortgage with Country Wide for three years. It went well, we never missed a payment and they did everything right. Last summer, after Bank of America took over Country Wide, I was notified by my town that BOA was not paying my property taxes. I called BOA and they promptly paid them. The next week, I received a statement from BOA that my monthly payment went from $890.00 to $2,290.00 with no reason stated. I called BOA, but they could not give a reason. They instead told me to try and get a loan modification. I was transferred to that department.
The man told me I did not qualify because I was up to date on my payments. He then told me to miss a couple of payments and call back the modification department. I did as I was told. When I called, they put me on a three-month trial period of $1,200.00. I promptly paid the next day. I received a statement a week latter saying that the $1,200.00 went to the late payments and penalties.
The next week, I received a letter that they were accelerating the mortgage and starting foreclosure proceedings. Two weeks went by and then, we received a letter from BOA's retained lawyer pushing my foreclosure and asking for my business by retaining them to stop my foreclosure. I retained a different law firm for approximately $6,000.00 to help with the modification. BOA just sent me my new modification. It lowered my payment from $2,290.00 to $2,210.00 still over twice the amount of our original mortgage.

I have been instructed by Countrywide Homeloans (before B of A purchased them) to default on my payments for the mortgage so I can qualify for home modification. The agent explained to me that if I continue to make payments on time, I will not qualify for any programs. I was making my payments despite the fact that I was struggling to make the high payment and did not want default on a promise I made to the bank.
This all happened following the increase in my interest rates for my mortgage and the bad economy which lead to the decrease in my home price to below half. I have been waiting for about one year and half now to hear from Bank of America regarding a re-modification they are looking into for me. What is more depressing and frustrating is that when I call Bank of America, I get absolutely no answers.
I called at least twice every month to ask about the status of my re modification, none of their agents gave me any information. They just advised me to call back in two weeks and sometimes they transferred me from one department to another and most of the time they disconnected me after holding on the phone for over 20 minutes. Currently, I don't know where I stand and what is the status of my home with them. It has become so frustrating that I am seriously considering just walking away from my home. This has been the most frustrating experience. Not knowing where I stand and what is the status of my home is not only putting my life on hold and preventing me from just moving forward, but makes me unmotivated to call Bank of America and ask. I have many financial problems that have occurred as a result from receiving the wrong advice.

I applied for a refinance of my mortgage last October 2009. I spoke with a Rodney **. He took my information and told me that I qualified. I was told it would be two months for the process. I waited until December and contacted Rodney and was told that it was on someone's desk and had not been submitted yet. I received bank forms to complete and also a request of proof of income. I complied with their request and forwarded the items to Melissa **, then after a month or so, there was a request for copies of some of the same documents that I had already sent. I was told they were never received. Since an amount of time had gone by, they then requested updates on income information because the information they had was no longer valid.
Now it is six months later and I was just informed that my debt to income ratio does not meet their requirements, after I was told by Melissa ** 2 weeks ago that she hoped to close the loan last week. Now I have been told by Diego ** that I have to wait a month and I can then apply for an MHA which I believe is Managed Home. I've asked why they put me through all that if I wasn't going to be approved and no one can give an answer.

We received notification from Wilshire that our loan was acquired by Bank of America on February 7, 2010. On March 11, 2010, we received notification from Bank of America that our loan was past due (which was more than a month after we were notified by our other lender that our loan had been transferred). My husband called Bank of America prior to the March due date for our mortgage payment and he was instructed to mail a check without the account number (which we did do). The copy of the check I have was dated March 1, 2010. We are responsible consumers. The letter we received from Wilshire stated Bank of America should have notified us within 15 days. The letter received from Bank of America was dated February 27 (after the 15 days) and was not postmarked until March 11, 2010.
When I called BAC, I was instructed to make a payment over the phone because my account was past due. I explained to the Bank of America manager, Kevin, we mailed the payment. Kevin then told me that the person that instructed my husband to mail the payment was incorrect and my account was past due. He stated we needed to make a payment over the phone and assured me that the check would not clear and wanted my checking information immediately. I asked Kevin for something in writing clarifying what he was stating. He said, "He doesn't have access to outgoing email so he can't give me anything in writing." Unfortunately, I gave him the information for a check by phone and the original check cleared March 16, 2010! I called BAC again. The man that answered the phone said, "No ma'am, your March payment has been made. Where is your April payment?"
I asked him what he said and he repeated it. I explained to him the month was still March and April's payment is due April 1, 2010. The representative further explained that my check by phone did not process for some reason and that it would not go through in the future but the mailed check did and my payment for March is current. He still wanted the April payment. On March 19, 2010, my husband and I contacted Bank of America to help us get into a fixed rate loan. We were told that they could not help us because our mortgage is less than 31% of our income. I asked if there was any way they could at least refinance the loan and put us into a fixed rate so we don't lose our home.
We owe almost $100,000 more than the house is worth now because of the economy. He said there was nothing he could do to help us because we are current on our loan and not more than 60 days past due. If we are ever 60 days past due, call him and see if they can help us then. On March 23, 2010, I received a bill dated March 18, 2010. BAC has increased my payment from $1127.98 to $1358.60. The bill even states that my adjustment for the ARM isn't until July '10 but they increased the mortgage payment unjustly. I called to see why. A woman answered the phone and stated, "The system is down. I cannot help you or have someone call you back. You need to call back."
The letter dated February 7, 2010 from Wilshire specifically states "Except in limited circumstances, the law requires that your present servicer send you this notice at least 15 days before the effective date of transfer or at closing. Your new services must also send you this notice no later than 15 days after this effective date or at closing."
We did not receive notification of a change in lender from Bank of America until we received a past due notice on March 11, 2010. Bank of America can't send consumers anything in writing. These are unethical business practices. (Demanding payment prior to the due date on a current loan twice). They increased our monthly mortgage payment without justification. Since the end of February, Bank of America has caused undue stress on our family. We are responsible consumers and would like to be treated fairly.

I called up Bank of America for a loan modification due to the fact that I'm three months behind in mortgage. All they kept saying was "would you like to pay now?". I kept trying to explain my situation but all they kept saying was "how much are you paying now?". How would I get through to them that I need help when all they keep saying is how much are you paying now? I will end up in foreclosure soon and need help, but they don't care. I am financially in bad shape but they don't care. Please help.

We have provided everything that was asked for. Then received an application basically that would have made us start the process all over. Our house is scheduled to foreclose on April 14th. We have been doing paperwork since beginning of February and sat with no answers for many weeks. We have every intentions of doing the right thing, but they are keeping us from doing anything including getting the amounts due to avoid a foreclosure stating that it is pointless since we are trying to re-modify. That would be good and true if we knew where in the process it was and if it was re-modifiable.

In November 2009, Bank of America provided a loan modification which was never honored. For the past four months, I have been given conflicting and often inaccurate information and/or instruction regarding the processing and status of the loan modification. I have since received default notifications and Bank of America has not honored the agreement.

We applied for a loan modification through Bank of America February of 2009. After calling everyday for 5 weeks straight, someone was finally able to tell me they received our paperwork and it was being processed. We have an interest only loan and have paid down very little principal. Our house is not worth what we owe on it so that makes it impossible to refinance. We first received a letter in May stating we were not approved for any modification at that time.
I called so many different people at Bank of America and not one person could tell me why. So, I then resubmitted all the paperwork again and they came back with an offer 6 weeks later locking us in to a 30-year fixed, which was wonderful news! The only problem is it didn't change our monthly payment which is what we were having problems with. We figured to take the deal and try and work it out after. We signed the letter one day late because I was out of the state because of a family member passing.
Bank of America sends a letter saying the offer is no longer available and states we are still on our regular loan.I then resubmit paperwork again and continue to get no answers from anyone on the other end. I truly feel they are taught to not answer anyone. In the 300 different people I spoke to I want to say 5 of them were actually helpful and seemed to know what they were talking about. The others seemed to not know anything about mortgages, nothing about real estate and most of them couldn't speak English, which is even more aggravating when you can't understand the person on the other end.
So, after all this and waiting of a year I receive a foreclosure letter because we are $10,000 behind. On top of it, the kicker is they have had no problem taking well over $2,000 in late fees. When they can see that we are having a hard time paying because of job lose and reduced income, they still have the nerve to take $2,000 in late fees. I resubmitted all paperwork again March 9th, 2010. I finally get a person on the phone today, and after asking me when I submitted (like they can't see it on their end) she stated they received it and it was declined and she doesn't see why just that a letter was sent to us March 20th.
I have dealt with Bank of America on the mortgage end, the car loan end and the end of being a realtor and having my clients trying to get a loan. They are by far the absolute worse bank out there and the government continues to let them get a way with it. In this economy, when so many people are struggling, they allow this. It's sad we have no one to help us anymore. So it seems now my husband, my self and our two children will be out of the house we were trying to keep for our kids. We bought right before the market crashed and we can't do anything. Having such a helpless feeling is the worse feeling in the world.

I tried to get help with a short sale and was told that they couldn't help until I was sixty days in arrears. I am totally upset with this company. I am trying to do the right thing, and get help to resolve my problem with my house issues and BOA is no help whatsoever.

I refinanced my home mortgage loan with Bank of America on 2/03/2010 and faxed all documents. The other rep Adam charged me $450.00 processing fee by my VISA card and told me that it is 100% refundable if loan doesn't go through or if loan is completed. On 2/18/2010, Ingar ** declined my loan refinance and I should expect the refund of $450.00. But after 3 weeks of waiting and keep calling both Inger **, loan processor, and Adam, loan representative, no response from Ms. Inger **. It is more than 30 days from 2/18/2010 and still no reply for my refund of $450.00. So I have to file a complaint to Bank of America for not refunding my $450.00 loan processing fee after they declined my home loan.

After having our first baby, my wife and I needed to move to a bigger house. So in Sept-October of '09, we put our house up for sale and began the task of looking for a new home. We found what we believed would meet our needs and after successfully selling our house, we moved to our new home. Because the new home was a short sale, we knew that our offer was subject to third party approval. Enter Bank of America. And we also knew that we could be waiting for at least six months, so we were happy to rent the house in the meantime while we waited for all the paper work to be finalized.
We offered $300,000 for the house and the owners who'd listed it at $313,000 accepted our offer and signed a rental agreement with us. Long story short, after waiting months and months (it's now nearly April), after selling our previous home, after being pre-approved for a loan, after moving into the new house, Bank of America has finally, after dragging its feet, decided to counter offer at $390,000! Setting aside the question of whether or not that price accurately reflects the market value of the house, would we have moved into this home if we'd known that the bank would ask nearly $90,000 more than the listing price? This is a short sale house, one that has had other buyer's walk. It's been on the market nearly two years and the next likely step for it is foreclosure and the bank wants to highball its offer?
I understand the whole "approved-by-a-third-party" contingency but if we walk out on this house, who wins? We have to move again. The house will likely go into foreclosure and the bank will lose money. Our offer was made in Oct./Nov. and the bank is just now getting back to us? Surely, they saw our offer months ago? Surely, they could have assessed the offer months ago? Surely, they could have indicated our offer was insufficient months ago? Short sales are anything but. While Bank of America may be legally in the right, from the family point of view, they are out of touch. Go figure. A big bank, out of touch with main street.
It still depends on the outcome but if we are forced to move, we will have to spend the time and effort to find a new home and to pay for moving again, plus we will have lost some of the money we have put into this home just to make it livable.

I have the same story as everyone else trying to get a modification with making homes affordable and Bank of America. Bank said, I qualified and gave me 3 temporary payments to make, after 3 payments were made and a month had passed. I never received anything. I called and was told they were giving me 3 more temp. payments because I failed to send documents needed "this was not true" they received all documents they were asking for again. After those 3 payments, still no word, I called again and was told to make 1 more temp payment, after that no word, I called again and was told to continue making temp payments until I heard from them "with no paper work stating that."
I am continuing to do this. But starting to feel I should just save my money for the move when the throw us out. By the way, foreclosure had never started through the courts until I starting complying with this program "which was suppose to put foreclosure on hold" Help! what now? Losing my home as I make temporary payments while waiting for making homes affordable loan to be approved.

My home was purchased in September 2006 through Countrywide Home Loans. I made bi-monthly payments until the summer of 2008. At that time my checking account was compromised and my automatic withdrawal payments were declined. My money was not reimbursed by the bank. Since that time, I have repeatedly requested assistance. In September of 2008, I received a letter from them about the Home Saver Advance Program. The letter mentions to simply sign the enclosed forms and return them in the pre-paid envelope by October 18, 2008. Note: Nowhere does it mention other papers required. I called repeatedly for months and was told it takes time. Finally, one day in the late winter of 2009, I was told that the loan was refused because I did not send in some other paper required. They had the papers I signed and sent back.
I was advised to write a letter, submit papers and we would attempt another workout.
A member of the (Addison Cap Team?) advised me to begin paying the loan amount which I paid prior to the "internal rate reduction payment" for the month of March. I mailed that payment on March 3, 2010. I received that check back today and was told that my account could only be brought up to date by paying what amounts to 4 months of payments. I was told that my original internal rate reduction agreement could only be discussed through their lawyer because it was in litigation. I made every payment during this time. I only missed the 2 payments form, the compromization 2008.
At this point, I will send in the "required" paperwork and hope for the best. There has to be a way to stop these people. I get a different answer every time I call them, sometimes I am relieved and most times I am more aggravated from the run around!
My father lives 200 miles away and I have been going there because he has developed heart problems and has been hospitalized a few times. I have also been helping one daughter who has rheumatoid arthritis with a 4 month old and a 5 year old. Her husband has a degenerative spine disc condition and can not pick up the children from school or nursery when my daughter has to work late. His condition has recently grown worse and he has not been able to work every day and I have been helping financially as well when I can. My other daughter recently went through a divorce and lost her car, as you will see on my bank statement, there are charges for car rentals through Enterprise which were charged to me and subsequent deposits in that amount which she made to cover the charges.
Her daughter, my granddaughter has asked me several weekends to come and get her for the weekends because of her parents still fighting, she is 60 miles away. All of these things have caused more stress on my finances. I was safe with my mortgage at 1091.67. Now, at 1358.19, I will have to say Sorry, I cant help you. I also think my son may have to quit college so that he can get a job.
Please help with this matter. I have been attempting to change this since it happened. I have missed no other payments other than those when my account was compromised. Even though with the recent real estate changes my house is now worth $40,000 less than what I owe, I would still like to remain here.

This started last year 2009 March, we called BOA to do the home modification and was told that it will not start until April 1, 2009 and to call back then. I did so and was told that we will be put on list. As the end of April approached, I called again and was told that we will be on phase 2. Now we are already having a hard time paying the mortgage payment because BOA raised the payment every year, so we were trying to get some relief from the increase of the mortgage payment.
Well, as time went on, we had to contact someone else for help and begun to pay them which got us three months behind in payment. We then had someone from BOA to call us and was asked why we are not doing modification with BOA and that they can do what the other company was doing. Well, we dropped the other company and went back to BOA and was told to make up the three months payment that we were behind on.
We started making extra payment which was 1,000.00 dollars house payment was 975.00. Well, October rolls around and we get a letter from BOA and stating they will foreclose on us unless we pay 5,000.00 in full. My husband that call and make an arrangement with some lady who told him that all we have to do is make a few payment starting in November of 1,500.00 a month and that will keep us out of foreclosure.
Now we paid 1,500.00 in November, December, January and the end of February we paid 3,000.00 and while we thought that we were coming to an end of going without food, they tell us we still own over 2,000.00 for March fees is what my husband was told, but mean while we received a letter the first of March stating our house payment will be going up to 996.00, but get this, another lady.
He called after we received a letter stating that we did not make a payment of the first of the month, but they got the 3,000.00 dollars out of our account on March the first and on top of that the house payment went up to over 1,000.00 monthly payments but we was only sent the letter stating 996 a month payment. Tell me is Bank of America scamming all of there clients? The Bank have used the American peoples money and is now scamming America out of more. What do we do, the hard working people in this country that is no longer free?

I refinanced my home last March 2009. I received a letter earlier this week stating that I was past due $220, which I found odd because it is a small amount compared to my mortgage payment. I found it even weirder because I recently checked the assessors’ website and the property taxes actually decreased (silver lining). I called this morning only to have a man tell me that if I didn’t pay the $220 by the end of the month, they would report me to the credit agencies. I talked to customer service and found out that the balance they were speaking of contained two $75 late fees. After looking at my statement and looking up my taxes, I called to have the insurance specialist tell me that a "little mishap" happened with all of the loans that were processed around the time mine was. That little mishap was Bank of America, attaching a company owned flood insurance policy to every home that did not have one prior to the refinance. Mine was $870/year.
I further found out that they had been billing $12/month for a reserve in case their estimates were off. That seems like a nice service, but the estimates are based on what the county tells them they will tax, and what my insurance company is going to bill them. Bank of America imposed $1100 of extras onto my mortgage without asking me. They were happy to refund the amount but think of all the people that just go with it. This is a major problem. It’s even more concerning to me that they were imposing $150 of late fees for a service I didn’t want to buy, then threatening to report me to the credit agencies, all without informing me of the added charge. This seems like a decent opportunity for a class action lawsuit. I believe in my research, I ran across a federal statute that required the banks to notify customers if they were going to impose a mandatory flood policy, but it did relate to FINRA placing the property in a flood zone.

Bank of America has put my stress level through the roof. I honestly feel they are trying to send my house into foreclosure. It began back in Oct. of 2009, when I lost my job and we were struggling with our $1,380.00 payment. I called BOA to find out about the making home affordable plan. They took all of my financial info and said we were pre-qualified and our trial payment would be $900.02. They said to make this payment for 3 months and then we should receive documents from them through fed-ex. So we began to make our payments.
At the end of Dec. we received a notice stating that they were going to begin foreclosure proceedings if we did not send in the full amount due which at this point was approx. $1,550.00. My husband called only to find out that they have given us the wrong trial payment amount. It should have been $1,182.02. They said disregard the notice and begin paying the new amount, which we did right away. We have made this payment on time each month and kept in constant contact with BOA. Keep in mind we have lived in this house for 3 years.
All of the sudden, I receive a notice saying that our payment will go up because our flood insurance is too low. I was thinking how is that possible, we have been here for 3 yrs and now all of the sudden they are saying that. So I went straight to my ins. co. and got it fixed so there would be no increase in payment. A few days later, I received another foreclosure notice. I called right away and was told it is taking longer than expected and it would be April before I got my paperwork. Needless to say, the many times I have spoken to someone at BOA they have said, "I will forward it to my supervisor and have them to expedite your paperwork."
Just 2 weeks ago, I spoke to someone who said I should have it in 10 days. Now, it is April before I will get it. According to their records, I am 3 months behind, which is not true because I have made all of the payments at the amount they told me and have not been late. I think BOA has a serious communication issue. Considering they call all the time and don’t have a clue I am on the plan until I tell them and they check the notes. Lately, I have gotten smart though. I have gotten a voice recorder and begun recording our calls. Just in case something happens and they suddenly lose my records or in case I have to contact an attorney, which at this point I am beginning to feel is inevitable.

My mortgage to Taylor, Bean and Whitaker was transferred over to Back of America last August of 2009. I didn’t know this until later. It was Sept. of 2009 that I was looking for the coupon for my mortgage, but didn’t receive one. So I sent my mortgage out to Taylor, Bean and Whitaker. Later following a couple of days, I received in my mail a coupon for Bank of America, with all my information. I called them up and told them I sent my payment to Taylor, Bean and Whitaker. The guy said, “It’s ok, I’m sure it will be transferred over to us.” He added, “Don’t worry about it.” Then when I pick up the mail, I didn’t see another coupon for the following month, just the one they sent to me late in Sept for Sept.
So I sent them the mortgage money to them with Sept. coupon, but cross Sept. off and wrote Oct. So then I started to get phone calls saying I was late. So I called Bank of America again and talk to a girl and she said, “Give us copies of all your payments to show you were on time and by the way it looks like, all Taylor, Bean and Whitakers customers are having the same problem.” You would think common sense says that this problem is on your end? So I did. I sent them a Certified mail. So I called them up and asked if they received my mail, and they said, “I see the problem now.” He said, “In August, when Taylor, Bean and Whitaker announced bankruptcy, the United States government is holding the checks.”
I asked him, “Well can you fix this problem in the system so I don’t get anymore phone calls?” And he hung up on me. Then later next month, I get another phone call saying I was late. Well I called them back and said, “I will charge you with harassment. This problem is out of my control, I sent you all my bank statements, I called every month to fix this problem and no one is doing a thing to fix this.” My credit is ruined. I can’t sell my house if I wanted to because they can’t fix their own system. My last payment for Jan., I sent without a coupon. They keep sending last month coupon to me. I cannot tolerate this stupidity on such a big bank like Bank of America.
I had a person call me again saying that I do not owe them any money the check from August has been released. Just now today Feb. 9, 2010, I had a phone call saying I owe them money from Jan. statement. I told the girl you better look at my account because the check from August has been released from the US government. I told her to send me a letter saying that I owe them any kind of money because now I have to hire a lawyer and sued them. I cannot tolerate this harassment abuse any longer.
2/11/10 Update: I just received a letter from BAC saying to send copies of my August and Sept. checks front and back. I sent to them Feb. 5, 2010.
I don't know what to do. Taylor and Bean say the checks are in Jennie M. hands right now. I can't even do my taxes because BAC gave me the wrong amount of interest on my mortgage to give to the IRS. BAC keeps calling me every day and the last time I spoke to them they said I owe them 2,100 bucks. I prove to them so many times I was not late ever in sending my mortgage in. The last time I talked to them I almost had a heart attack. Because no matter what I do or say or send documents by certified mail, they ignored it. The one girl told me the money has to come from somewhere. When will this nightmare be over?

I have been in the hardship process and sending hardship letters for over a year now. I believe this will be the 4th attempt. I sent my file to the Attorney General's office, Kelly ** reviewed my file. Due to the unfair lending practices of Countrywide Home loans, she recommended my loan to be treated with the same reductions in payments given to those who had lost their homes in a class action after she reviewed my file. She referred me to Chris **, Catherine **, Mark ** and finally, Zack ** told me I qualified to get a refinance. Then once again, more documents came in the mail for me to resubmit and begin the whole trial process again.
Countrywide has damaged my credit and caused me to live a cruel existence in order to keep my home. They were able to destroy many other people's lives with their unfair lending practices. This is why I feel I should be given the opportunity to refinance out of this horrible loan as hopefully, a new beginning with Bank of America. Before I got involved in this loan, I had never been behind of my mortgage payments since 1989. The ARM loan I was given in 2005 was supposed to help me improve my credit. As we all know now, the interest rates keep going up and up, destroyed consumers' credit and eventually took their homes. I managed to hang on barely, but feel my loan deserves to be refinanced due to unfair lending practices from Countrywide Home Loans. I have enclosed my original disclosure documents. As you can see that my rate was to increase up to 15%, I was charged $3,000 over good faith estimate on the day of the closing. My payment kept increasing at alarming rates.
I have been told I qualified for the Make Homes Affordable Plan only to have to resubmit documents again and again. I have had to rent rooms out in my home in order to catch up on the payments so Bank of America would not foreclose on me. I had a short foreclosure in place but managed to bring my loan current. I do have a good job and the ability to make payments, but refinancing to a lower rate would ensure my ability and allow me to make my payments for your loan as well as other loans I am responsible for. Hopefully, the banking industry will begin to value good customers again. I have a solid job as a special education teacher. I commute long distances to teach in a high demand for special needs teachers. I have worked hard to stop the foreclosure on my property and bring my payments current. I am not sure if this matters anymore since I know that a national bank and forgiven for all the harm done to consumers and given large amounts of money from Obama.
Very few consumers ever saw this money. I am only one of thousands in this condition. Our fate will soon become the National Bank's fate or the end of the banking industry as Americans know it. I am just interested in getting my loan rate reduced. Recently, Missoula was picked as the 2nd in the nation for economically depressed cities in the nation due to Stone Container closing its mill that provided approximately 500 jobs that averaged 70,000 per year in salaries. The loss of these jobs will have a devastating effect on Missoula's economy. The well for this property is located on another property. The economy downturn and the lack water easement would make this an undesirable home for the bank to repossess. Combined with the lack of ability to resell the house and it would require the owner to drill a new well.
I would greatly appreciate a refinance at a lower rate that would ensure a win-win for both the lender and the homeowner. The present payment of $1850.00 is too high and the interest rate of 8.375 is unreasonable in consideration of the unfairness of lending practices in the original loan documents. I would greatly appreciate a loan with an interest rate at 6%. This would lower my payment and make it possible to make my payments with current increased charges on taxes and insurance. I represent one person (loan) at a time from the future of our country. What is the vision of your bank? Are you interested in gaining more and more properties? Who will make the payments that support your bank and help you keep your job? If the government has to pay for bank failures, will this affect your job too?
I don't have the money to get my taxes prepared at present, but I have enclosed two of my latest pay stubs. I have already qualified, please ask all of the names mentioned and look at the history on my file. My credit has been destroyed. I was given a trial mortgage payment. After the trial ended, I was given short form foreclosure notice and all payments and late fees were due. The next month, my mortgage payment was increased to $1960.17 per month. I want to take this to trial and have an attorney help me to stop these predatory lenders from taking people's homes and making incredible profits off of hardships caused by lending practices.

Bank of America has managed to completely step back and avoid responsibility for the actions and non-actions. I submitted a request for a loan modification several months ago. In December, they decided to hire a collections company to serve me with papers. The collection office drop off the paper work on my house during the holidays. The drop off date on the envelope was December 29, 2009 but the documents for loan modification had expired in December 14th 2009.
I have spoken with more than six customer service agents from January-March 2010 and with three supervisors which take notes from me, information to qualify and confirm they will resubmit the request for modification but it did not happen. I have spent hours on the phone. Their customer service person I talked to last hour said, "Even if you have gotten the request for modification offer on time, we do not guarantee it will go through." In other words, up front they decide not to approve you but waste your time but sending you documents with their offer and decide not to follow up with any of the requests they said they will submit. They are worthless and will not see no one's interest. Their customer service department is full of useless employees which obviously don't know what they are doing.
I spoke with Cristina M, one of their supervisors and I had it. I can try to go to their branches, walk in and talk to someone instead. It is amazing how companies with large revenue don't have the smarts to hire people with the least amount of skills to follow up with their customers and actions they say they will take over. I do not ever want to deal with them. I hope to have the opportunity to refinance and take my loan to another bank. I am done with Bank of America.

I have been working for one year on the modification process. I was approved by Countrywide Mortgage back in January of last year. Then they fell headfirst into the arms of one of the biggest corporate fraud processes that are happening right under the nose of the federal government. They lose paperwork on purpose and stretch you out by passing you from department to department. Making Homes Affordable is baloney! They never intend to do anything but short sale or foreclosure as I continue to make the payment agreed upon by Countrywide and they keep piling on the interest. Foreclosure of a home we have lived in for the last 24 years because our business has suffered a drop by 40% in the last two years.

My loans started with Countrywide’s Full Spectrum Lending; Bank of America took over Countrywide loans. I had an 80/20; Bank of America put my property taxes with my mortgage pay; one payment was $597.89 and the other is still $181. My loan is a 30-year fix convention loan. My payment $824.00 and that was $597.89, started an escrow account of $3300.00. I protested my property taxes to reduce my negative escrow; Bank of America added my home owner ins in my escrow account. I asked for a loan modification. Yes, if I can pay $861.00 for three months and my payment is $824.00.

I am a realtor trying to sell a home in Jacksonville, TX. The buyers and the seller have been waiting over 4 months to close on this property. Bank of America holds the note on this property and agreed to a short sale that was $5000 less than what was owed. After getting the BPO turned in over 3 months ago and talking to a different person every time I called or the owner called, we have now been told that they know nothing about the short sale. Bank of America now will not talk to us about the short sale that they promised the seller but has gone so far as to hang up every time we call about it.
An attorney has sent the owners a letter of foreclosure but has put it on hold for 2 months since they were told of the short sale. We cannot get anyone with Bank of America to talk to us and cannot sell the property without their consent. The buyer has waited over 4 months and is so frustrated that they will probably let it go. How can a company that received all the money that they did from our government not want to sell this property? They could get it off their inventory and would have only lost $5000 but now with penalties and interest it is way more than that.
Come on now. Is their any way that we can get some help from their company or even our own government? It looks like our tax dollars that bailed them out gave them bigger attitudes instead of kind hearts that should help the consumer. Let’s call in their debt and see how they feel. The seller cannot sell their home and their credit will be ruined. This house will be foreclosed on without even contacting the seller.

It is very amazing that the government and Bank of America is spending so much money and still have such bad service or agents that answer the phone chewing gum since losing a home must not be such a big matter to them. After an hour of hold and being transferred from one department to another, just to be read that you don't qualify. It is such a great disappointment to have those people working.

My wife and I didn’t choose to have Bank of America to service our home loan; Bank of America chose to take over our loan last March. Operating initially as Countrywide, they took our regular automated bank payments and applied them towards principle, interest, escrow and prepayment, but they also took a little off the top and hid it away somewhere.
In 2009, they took and lost $653.02 of our prepayment. They are charging us interest on money we have paid 4 times; they have lost our entire payment, 3 times they found it a month or two later, one they have not yet found. They are charging us late fees for on-time payments. As a result of them losing money, our escrow has fallen behind, and now they want us to pay more into escrow to make up for their mistake. For the second time in 3 months, they are threatening to take our house if we don’t give them more money.We have detailed bank records showing that we have paid every one of our payments on time; in fact we have consistently overpaid in order to reduce our principle. The theft of money was subtle at first, $76.51 in March, $23.49 in August, then they started getting greedy, $250, then $326.51. Even I would not have noticed if it were not for them losing 4 payments in a row and starting to play games.
I have sent them 3 recorded delivery letters to them via their Virginia service agent, and requested they resolve this. Instead they just ignore us. True, they did send us an email 14 days ago stating, “We have made your account a priority.” But they have actually done nothing. Since receiving that email, they have again threatened foreclosure and have increased our escrow payments to cover another of their errors. On March 1st, two weeks after sending the first letter, I followed up with a phone call to Mr. Lawrence **, SVP, Credit Products Manager, Bank of America Corporation. I explained the situation to him, but he did not listen to what I said, because in a subsequent call, he clearly had no grasp of the key issues. I think he still does not understand.

In November 2009, I received notice from BAC that my mortgage (which they took over from Countrywide) interest rate would drop several points effective January 2010. In December 2009, I began receiving calls and written notices from BAC that my mortgage account was in arrears; that I had not paid my mortgage payment for November or December. I was informed that my credit report and thus my credit score would suffer as a result of these late payments. I use electronic transfer payments from my bank account to BAC. I had even received e-mail alerts from BAC in both November and December that payments had been received. I have never been late and am usually early with payments. I explained to the 2nd BAC caller that I was looking at my bank statements in front of me which showed the transfer of funds to BAC and received by BAC before each of the payment due dates in question.
I was told I would need to have my bank, not me, (I had already sent the requested information after the first call) send their research department proof of the electronic transfers. They provided me with a fax number for their "research department" to give to my bank. My online banking department sent proof not once, but twice, January 5th and again January 19th, to the BAC research department, of all payments (made on time) for the last 19 months.
They finally acknowledged in late January that these documents had been received, but not until I informed them that I had hired an attorney to help resolve this matter. Still I continued to receive weekly calls from their Debt Collection Department demanding payments that had already been paid and I continued to jump through their hoops to resolve their error. Each time I called the department that I had been referred to, the employee (that would only give a first name) would tell me that they would look into the matter and call me right back. No one ever did.
On January 20th, 2010, I received a written notice from BAC titled "Notice of Intent to Accelerate". This notice now said that I had not paid December 2009 or January 2010 payments and that I was being accessed late charges. On this date, they also sent me a letter stating that they had made several unsuccessful attempts to contact me for additional information.
And on it goes. On February 6th, I received a collection call from BAC's "Home Retention Department" providing that they had no record of my bank sending any fax pertaining to the payments and they only had a record of my January 6th phone call. I told this employee that I had talked to the "research department" on January 20th, and they said the same thing until I told them that I had a lawyer now handling my case and somehow she suddenly "found" the faxes from my bank and could see that I had, in fact, made the payments. She assured me that it would all be cleared up and noted on my account with penalties removed, within a few days. Still the calls came.
On February 8th my attorney filed a "Cease and Desist" order re: Unlawful Attempt to Accelerate Debt: Unlawful Collection of Debt as proof of my payments had been provided and all payments were current. All certified letters from my attorney to BAC have been signed for, but there has been no response to their firm and I continued to be harassed weekly. In addition, my BOA credit card, which is also paid on time, has just had the credit limit severely dropped (making my debt to credit ratio very high) BAC has reported the alleged mortgage debt to all 3 credit recording outfits and it now appears as a negative on my reports.
As of today, my lawyer has discovered she cannot work on a contingency plan as originally thought as BAC uses an in-house collection department and not a 3rd party collection firm, thus avoiding the "Fair Debt Action" laws. I am just a self-employed person in the building industry trying to stay afloat and do not have the several thousand dollars necessary to now pay my attorney for the work that has already been done nor to continue to draft a complaint and summons to be served to BAC. What recourse does a small pebble like me have against the rock crushers like BAC?

They mis- post my payments and then charge me for late fees. They started charging me for home owners insurance, even though I have repeatedly sent copies of my insurance. They sent certified letters to my house every week and then charge me $120.00 for each letter. They send representatives to my house to "see if we are still occupying the premises". I agree that I have been behind in mortgage payments, but it is usually under 30 days and a payment is made every single month. Of course, we live in our home.
They call my phone number over 12 times a day, it is usually a computer generated voice telling me to contact them about a serious issue with my account. I have been making payments at the local branch office, because I cannot afford to pay $20.00 everytime I make a payment. My payment is never posted correctly. It goes into a partial payment fund while they hound me for the payment. Sometimes I pay over the amount due and ask that the additional funds be posted to principle. Nope, it all goes into partial payment fund. I am so frustrated. I spent 45 minutes to an hour every day from work being forwarded from one representative to another and then oops disconnected.
I am constantly accruing "fees" for certified mail, personal representative contacts, late fees. I have to clock out almost everyday at work for close to an hour to take the calls so that they stop calling me.

Last year, 2009, I was laid off and I am currently still unemployed. I started to fall behind on my mortgage in October and called B of A for assistance in November since you have to be late first before they will assist you. I was told I qualified for the Government Program & would receive a trial offer in the mail. In December, my information was put through and documents they requested were also faxed. They said it could take 30-45 days to process. On January 10, 2010, I was approved and on January 25, 2010, my review had been fully completed and approved.
It is now March 16th and I still have yet to obtain any useful information from the bank regarding my modified mortgage. No one has any information other than I was approved. I have called consistently and the service provided is poor and useless. Last week, I just received 2 letters of notification at my house from a court appointed processor addressing foreclosure on my home.
The financial institutions want you to contact them and work with them so you can save your home and they can save the loan but then you can't even get anyone to acknowledge you or provide any valued and pertinent information! I am desperately wanting to save my home and if documentation would have been mailed to me on the approved program & modification after it was approved back in January, then I would not be receiving foreclosure notifications. I am not getting any answers or help from Bank of America and its associates. I do not know where else to turn to get someone to please help me.
Here is a timeline log of my phone calls and information: 11/25/2009 2:09pm Spoke to Kim about needing help. She transferred me to the Imminent Default Dept (IDD) at 2:18pm. (this is what they called it). Held until 2:37pm and spoke to Joe who told me I qualified for the Government program and would receive the trial offer in the mail. He left me phone numbers to this department and an extension which I was told later that there weren't any! X5356
12/1/2009 11:20 am I called to find out what I needed to do at this point. I held until 12:08pm and got disconnected. I called back at 12:14pm, transferred again at 12:20pm and held until 12:47pm. This is when I asked for Joe and was told there are no extensions. During my hold I also went on the B of A site to ask for help since I was having no luck. (I never received a response back from that). I spoke to Brian until 1:13pm. He asked me questions and obtained information needed from me to get my file put through.
12/14/2009 2:15pm I called to follow up. Spoke to Marc who transferred me at 2:22pm. I was told to fax over 2 months of income, 2008 tax returns and a hardship letter with attention to the MHA Dept.
12/17/2009 2:57pm I faxed all requested documentation to the MHA Dept. 1/8/2010 1:25pm I called to follow up. Spoke to Sylvia at 1:31pm where I was told my file was still in review and could be 30-45 days.
2/8/2010 2:37pm I called to follow up. Held until 2:52pm then transferred by Lisa to the IDD at 2:56pm where I was disconnected at 3:00 pm. I called back at 3:03pm and held until 3:21pm where I was transferred by Onya. 3:26pm Spoke to Latecia. This is when I was told that my file had been approved on 1/10/2010 and that all of the review was completed and approved. Latecia told me that I should be getting something in the mail at any moment, possibly that week because I asked about the modified docs especially now knowing all was approved.
2/19/2010 10:40am I called to follow up since I had not received anything in the mail. Spoke to Eddie who could only tell me it was approved too but didn't see anything else. He transferred me to the MHA Dept at 11:05am to see if they could further help me. 11:14am - 11:22am I spoke to Tamisheny (Home Detention Dept). She saw the same notes of my file being approved , didn't show any docs mailed and that it was still pending and to keep checking back.
3/9/2010 4:30pm (This was Mountain Time wherever I was calling). I was told their system was down and to call back. 6:04pm I called back. Held until 6:25pm and spoke to Crystal **. I asked for a supervisor since I had not received any clear and knowledgeable answers on my file. She asked to look at my account first to see if she can help which is what most have all said and I have had to explain the details each time. She had given me the same information I already had based on the notes she could see. She also stated that my account was now in foreclosure! I told her this is why I needed a supervisor that can possibly get me some answers because if my modification was approved in January, then foreclosure notices would have not started. I needed my approved documentation so I would know when the payment date started for an amount of $401.66.
No one can tell me anything! She, as the others said she wanted to transfer me back to the Home Detention Dept to see if they could further assist me. I asked her for a supervisor as this was a repetitive process that seemed to be getting nowhere. 6:33pm Crystal said she was transferring me to a supervisor and that she would update her on my account ahead of time. At 6:40pm, Crystal came back on the line to tell me that the system was now down and that I could either call back or she would leave a message for a supervisor to call me as soon as the system was up that evening before they closed or first thing in the morning. I gave her the number I can be reached at as I insisted a supervisor please call me back.
I did not receive any call back to date. This is frustrating and I believe unacceptable how Bank of America is dealing with it's consumers and not having any clarity or correct procedures with customer accounts. I have made sincere effort and doing whatever I can to save my home and to want to continue to pay my loan yet not one representative can give me any valid information or properly assist me? Now I'm having foreclosure steps started because of the delayed process that no one can explain. I did not know where else to turn and in hopes that something can be done with my complaint here. Please contact me by phone or email with any questions or additional information needed.
Last week, I received in the mail apparently dated from Bank of America on 2/25/2010, a notice just showing my request was received and that they would provide a more complete response within 20 business days. What is the problem? I was approved and waiting on modified docs! Could someone please help me? Since this is time sensitive, I am extremely distressed about my mortgage and saving my home. I appreciate your help, thank you. I could lose my home and I am desperately making attempts to save it!

Initiated Home Loan Modification in Aug. 2009. B of A has had all documents since Oct. 2009. They keep saying it will take an additional three weeks each month they have been contacted. Is there a government organization that investigates these banks for intentional delays? Due to my wife's loss of job in 2009, we have been depleting our savings and retirement accounts to maintain loan until modification.

I am a buyer involved in a short sale, Bank of America is the short sale lender. I wrote my offer on a home in July 2009, BoA finally approved the short sale with me as the buyer on 2/1/2010 and gave us until 3/7/2010 to close. As part of their letter, they state the closing agent/escrow officer is to upload a final copy of the HUD-1 for approval. It must be done 72 hours prior to closing. It was uploaded on 3/2/2010. I signed my docs, seller signed their docs, money was deposited into escrow on 3/4/2010 for a closing of 3/5/2010.
All utilities were transferred into my name at my agent's request, my homeowner's insurance was ordered and put in place for closing on 3/5/2010. The bank did not respond with an approval or a decline of the HUD, they indicated they needed more time so they extended it until 3/13/2010 without my permission but promised if we waited until the following Monday 3/15/2010, they would definitely have an answer on the file HUD-1. We followed up today and they have not approved or declined the final HUD, just put into their system. They now have until 3/20 (next Saturday) to approve the HUD. My interest rate expired today and I had to pay for another extension, they don't care. My current home has been rented, tenants were supposed to move in over the weekend but cannot because I cannot move. I pleaded with BoA to get my HUD approved last week and they just promised it will be approved today. Again, it is not approved and they want more time without any regard for me or my tenants.
I am also a lender and I know what they are doing is not legal. We have a binding contract (short sale approval letter) that states I must comply by the due date or I will incur per diem fees and my transaction could be canceled if I do not comply by their date of 3/7/2010. I have done everything I can do to comply, called BoA executive offices, called my local Congressman, called the BoA short sale department daily and still nothing. Please tell me I have some recourse, I want my house that I have now spent over $1,000 in inspections and appraisal. I want them to close my purchase now and I want them to pay for all of my extension fees. What they are doing is totally unacceptable and someone needs to stop them from this type of bad business and treatment.

My husband and I reside in a triplex unit that we signed a month to month agreement in the month of January 2009 with a gentleman who is an authorized agent, not owner, and of which we have not received a copy. The property has gone in and out of foreclosure a number of times. We have not had a problem paying our rent. The last time the property went into foreclosure, the bank had taken the property back, so we were told. We have made calls as to the inquiry of ownership so that we may remain in our home and be responsible for our rent. We were told to wait and we would be contacted. We have received a three-day notice to pay or move out from the previous owner indicated to be 'Cal Pak USA, Inc.' whom we had not had anything to do with before. The notice was dated 3/5/2010, we received this notice 3/9/2010.
We also received a phone call at 8:00 pm on March 9 from a male who stated he was property manager and needed to collect the rent. Today, 3/15/2010, we have received a letter from Bank of America indicating the status of the property and a contact number of their attorney. I called the attorney and he stated that the bank wants us out and the eviction process had been started. This has been incredibly upsetting because we do care for our home and we are not trying to get out of paying rent. We do rely on one income at this time as I have been unemployed for six months and have been actively seeking employment every day. I just do not know what to do or whom to contact for direction. Is there any person in the legal field that might be of help? Please let us know whatever you can.

My home has been recently foreclosed upon. Issues beyond my control caused this and Bank of America was the major contributor. They are inept, unorganized, and mostly in the dark. I tried everything possible to avoid this. I applied for a loan mod and almost a year later, I got a answer. B of A applied $40K to my loan and sent to me a letter saying "congratulations, you've been approved! " I thought it was a joke, but it wasn't, and they were not willing to negotiate.
So, the only option I had left was to sell my home. Unfortunately, the value was less than owed, (-equity) because of the property value drop experienced by everyone. I had a short sale offer of $30K less than owed, a very reasonable offer. During the short sale process, paperwork was misplaced, negotiators were changed, systems upgraded (not for the better), and time passed. We had to start this process three times over.
Well, needless to say, my home was foreclosed on and now we are homeless and my credit has a major black spot due to B of A's inept way of doing business. My home was sold at auction for $65K less than owed.
When I asked why they foreclosed instead of accepting a short sale, the reply was, "it was going to be accepted but we changed negotiators so much we lost track of what the home retention dept was doing". Nice work B of A, you're most of the problem! All this could have been easily avoided.

I have several concerns with Bank of America home loans. The main concern is that over an 18 month period of time, they reported me twice to the credit bureaus as being 30 days late. Both instances I was not late. They choose to misapply my payments. The first instance I was able to show them they had put part of my payment as an extra payment and did not apply the second half of my payment. They fixed that issue and removed me from the credit bureaus. This last time, I was in the process of refinancing my home with another financial institution.
Bank of America decided that they wanted to try to modify my rate (after me having tried over a year earlier and being told no). I did not ask for the modification and disregarded the information they sent me on this program. I sent in my final payment to them in December. My bank shows that they received my final payment one day before the due date. My loan was paid in full by the other financial institution in January on the 12th. During the first week of February, I received a call from a Bank of America collections specialist telling me that I was over 30 days late. I checked my statements and with the other financial institution to see what was going on. I then pulled my credit reports and saw the I, in fact, had been reported 30 days for the December payment that Bank of America received prior to the due date.
I contacted BofA and was told that I was wrong. When I explained that my bank shows that it was BofA's error, the representative did more checking and found that my final payment in December had been applied to escrow only. I asked for a statement of every payment that I made to BofA and to have them submit a correction to the credit bureaus. I was told I should receive a letter from BofA letting me know that this would be corrected. I have received my statements but I have yet to receive the letter correcting my credit bureaus. I was denied credit because BofA wrongly reported me to the credit bureaus and lowered my scores by 70 points. The company I refinanced with has since sold my mortgage back to Bank of America. I am terrified they will continue to ruin my credit because of their incompetence.

My husband and I were buying a new Highland home and they recommended that if we use their preferred lender Highland Loan Source-Bank of America, that they pay $3000 closing cost. So of course, we applied for the loan through them. My husband and I own a small business and we had planned on using money from our business bank account to pay for closing. Margie T. was our loan officer. From the very beginning, she was giving us a problem. Then we found out that they will not close the loan because they want to get my CPA to sign a statement guarantee that our business will not suffer if we use our own funds to close on the house, which he did not feel appropriate for BOA to request. They tell us that they will not close the loan one day before the scheduled closing. Here is the email I sent Ms. T. to further explain the situation:
"I sent all business and personal statements to Robert F. and Crystal multiple times. I even told Elena and my husband how the communication between you and your assistants is terrible. I have had to fax the same documents over and over again. I have all requests documented. I, at no point, implied that this money was coming from our personal accounts. And if you had all our personal bank accounts but not our business accounts in front of you, then it would have been obvious that we did not even have that much to use out of our personal accounts. Thus, that makes absolutely no sense. The facts are that you and your assistants have no communication nor did anyone call to clarify, if there was any question at all.
Secondly, you were stuck on our 2008 tax returns and hung up on $22,000 that we paid income tax on. Then after explaining to you numerous times that we were incorporated and do not receive a W-2 or 1099 from Exxon Mobil, you inappropriately tell me that you are going to try to get a copy of a 1099 (that does not exists) on our behalf from the IRS! This was your first inappropriate action against us.
Third, you tell my husband that we are approved for the loan but that we cannot use our business funds to pay for closing on the house, thus, we must borrow (the bank uses the technicality of calling it gifted) money from my family in the amount of $111,000. Even though my parents would have to pay gift tax on the funds and if we did not have the money gifted to us (all though we have the money in our business) we could not close on the house. That is when you said that you were looking for an exception on our behalf.
Mistake 4 was adding .25% onto the amount in lender's discount points, thus costing us $1000 extra in closing costs. Mistake 5 was telling my CPA that in order for us to close, he must sign a statement basically holding him accountable if our business is hurt by using our own money from our business account, holding us at the mercy of our accountant, in order to close the loan.
When this could not happen, you simply say too bad, sorry. The day before our scheduled closing. I am wondering if you were in our position, if you would not be livid. If you say you would not, then that is because you are on the other end of it. I do believe that BOA is unethical. Everyone I know has said as much. The bank took our tax payer money to bail themselves out, under the guise of stimulating the economy, but not giving loans. This is the absolutely truth and I think that everyone should know it. I will not just shut up and go away without spreading the word. I have all the documentation to support my claims.
Also, you have not been polite to me or my CPA. He did mention that you have been extremely rude to him numerous times. That is why he did not trust or want to deal with you anymore and he thought it was a good idea to seek a loan elsewhere. This is my last email to you in response to your claims that I did not provide you the correct documentation and that you claim that you did not know that we would not be using our business funds to pay for closing. Everything else will be formal complaints sent to the corporate headquarters and further."
We could not close on the house and now we are searching for a new lender. This has completely messed things up for us.

I went through a short sale back in Nov 2009, my property went to settlement and after months and months of a horrible, frustrating ordeal, it was approved by Bank of America. Now my problem is that the sale of my property is not being shown on my credit report therefore lowering my score. And it is also showing a balance of over $5000.00 per Bank of America and the negio I am not responsible for this amount. Of course I am aware that a short sale may hurt my credit but I think its only fair that they report my property as being sold and to delete the balance especially after I was told it was not my responsibility. I called today for over an hour and got the run around being transferred over and over again. No one could help me at all!
I just need this to be clarified asap as it is showing on my report. I totally understand that it was my responsibility that my home went into short sale in the first place although I did try time and time again to negio with boa (Bank of America) before it did. There are notes on file that reflect all my conversations. I am trying to piece my life back together as quickly and as best as I can. I am a single parent and I am not asking for sympathy just that boa corrects its mistakes. They need to reflect that my property was sold and that I do not owe over $5000.00 that was past mortgages. If you could please help.

My mortgage was bought by BOA. Last summer, my escrow was increased as of 09-09. I did not get a notification. I have my payments made through an outside company that collects from me bi-weekly and pays my mortgage on the 1st of the month. Every 6 months or so, they make an extra payment that goes to the principal (the outside company is owned by Bank of America). I did not catch the escrow increase. Nothing happened in Sept., Oct., and Nov. My regular payment was made with no issue. My December payment was made on time. Due to the escrow increase, it was $57.19 short.
On Sunday evening, 12-20-09, I got an automated phone call from BOA stating my payment was not made and I could pay on the phone. Not knowing what was up, I waited until Monday morning to call them and find out. That's when I found out about the escrow increase (why did this not happen in September?). I went to a local branch and paid the shortage. Then I called back BOA and explained the problem. They said they would waive the late fee (note that their call came in on Sunday night, the last day of the grace period).
I called my bi-weekly company and made the changes. But this takes a month to catch up. So anticipating the same problem in January, I called BOA on 01-04-10 and explained what I was going to do. I would go to the branch and pay the shortage. I also confirmed that the December late fee was reversed. They said it was. I went to the branch to make the payment and they said they could not take it because it was a partial payment. They could only accept full payments at the branch.
So I went to a BOA mortgage center branch and tried to pay. Same result. Why did they accept it in December? Finally, the teller called it in by phone and made the payment using check by phone. They waived the fee. This was done on 01-04-10, but the partial payment did not post until 01-06-10. I am all paid at this point. Okay, now the fun begins. On February 3rd, I got an automated call from BOA that my payment was not received. I assumed they were speaking about the February payment. I verified the payment. As it turned out, the extra payment from the bi-weekly company came in that month. I called BOA and I explained what I thought happened and the rep dispersed the extra money to principal. She gave me the figure. I was assured that all was caught up.
The next day, I got a letter from another branch of BOA offering assistance for families that can't pay their mortgage and I was more than 30 days late. My jaw dropped. I called BOA and spoke with a very rude gentleman who would not hear my story. He insisted it was what it was. I insisted on speaking to a manager. Finally, I got one. Then I realized they were talking about the January payment. I asked them to send me a letter stating that January was paid in full on time. They would not do that. All she would do is send me a letter that said my account was in good standing. When I looked at my Feb statement, I noticed that the Jan payment was listed as miscellaneous posting along with the escrow payment I made. It also showed 2 late fees December and January.
BOA, finally on Feb. 3rd, re-posted the payments as January principal, interest and escrow. But this made me over 30 days late. The December payment was not re-posted until 12-28-09. Then I did the math on the extra payment in Feb and they applied the money to principal $189.50 short. They took out the escrow shortages from Dec and Jan that were paid and a late fee that should have been waived. I called again. I went back to the mortgage center and tried to talk to someone, but nobody who knew mortgages was in. They called a customer service number and put me on the phone. 45 minutes later, I was told that they would open a research on the whole deal. I waited 2 weeks, nothing. I called again on 02-22-10. They would do another research. Also, they were to fix the problem with the funds taken from my extra payment.
It is March 12th and I have heard nothing. I still don't know why there was no shortage in Sept., Oct., and Nov. Their customer service is terrible. I do not trust anything they tell me. They are purposely reposting my payments late to create late charges. Now, I am in their system as a late payer. They have not damaged my credit (yet), but who knows what will happen in the future? I do not trust them at all. Ironically, they are calling me and mailing me a ton of refinance offers. Every time I have called to complain, they always ask me if I want to refinance as if they were not listening to my problems. I have started refinance with another company only to get away from BOA. I encourage anybody who is looking for a mortgage to run away from BOA.

Mrs. ** has worked tirelessly with Bank of America with the Loan Modification program to no avail. Mr. and Mrs. ** are seniors who lived in their house for over 30 years. Mrs. ** has sent paperwork in since the summer of 2009. She has re-submitted the same paperwork and has paid the trial period amount every month.
Bank of America is now saying that they owe $7000 or they will foreclose on their home. This is very unfortunate because of the time and effort on Mrs. **'s part, who by the way just had major surgery. Mr. and Mrs. ** need help immediately.

In July 2009, I called BOA to provide them my new banking information. Payments for my mortgage was auto draft from my account. However, come August 2009, I'm thinking my mortgage is paid timely. I get a call from BOA around August 29 letting me know my account was overdue and I was applied a late fee. I explained what happened and they stated they see the change on my account and not sure why they tried to take my mortgage from a closed account.
When I paid my September payment timely, or so I thought, they applied it to August. Therefore putting me behind for September. This went on until December 2009. Who can pay out over $4000 a month for mortgage? Not me. Anyways, the late fees started piling up so I called to discuss my account. In late November, I was told all late fees would be removed. Nothing done. They are still requesting late fees for their mistake. However, you will never get them to say it was their mistake that they tried to take my mortgage from a closed account. For several months, I have tried to get this corrected. To this date, I'm still asked to pay late charges and fees. That's not right. This error was not mine.
In an effort to lower my mortgage, I found a homeowner insurance policy that was about $279 less per month. Why then was my account increased by $39.57 a month? Instead of my mortgage going down, it went up. They said the $39.57 was a security blanket (sort of speaking). I told them to remove the home owner fees from the mortgage and I will pay it directly. I thought about bankruptcy but I didn't want to go that route. Why oh why did Countrywide leave?
Refinancing is out of the question. Because I am upside down in my mortgage, I can't get refinanced. It's a crazy situation when Obama asked companies to help the homeowners try to keep their house. BOA does not help you at all. All they want is money and more money. I asked about other options to help make things a little better for me, nothing. BOA couldn't do anything. I want so badly to leave this company but because of my upside status, it's hard. I thought about just throwing in the towel and leaving it all alone.
As much as I love my home, I don't like the financing company. Because of the frustration and aggravation, I have developed a spirit of depression. I can't seem to make myself to to work. I don't want to leave my bedroom. I don't want to leave my house. I have chest pains every now and again because the mortgage is going up and the value of the house is going down.

In August 2009, we applied for a loan modification with Bank of America. Which was approved after months of phone calls, lost papers, collection phone calls, collection letters, and notes at our door. We finally got approved for the loan modification with new terms and no payment until January 2010.
According to the loan modification, all late fees and missed payments were applied to the loan modification. (I have to pay now longer, and at the end, it will cost me more than before.) In December 2009, I received a collection letter from Bank of America, telling me we have to pay $7,000 to bring our mortgage current. I called Bank of America.
After talking to one of the Customer Service Reps and explaining the whole situation again and again, he told me to just ignore the letter and to make the new and agreed payment in January. I told him to make a note in my file that I will be making the first payment, when I am able to see the changes online. Bank of America made the change in February 2010. I made the first payment on February 5, 2010, which was partially applied to the outstanding balance of $7,000.
I called Bank of America and explained that the payment was applied incorrectly. The Customer Service Rep told me that they are going to fix it. I made the second payment on February 10, 2010, which was my February payment, which went missing. It was never applied to the mortgage. I called Bank of America again and explained the whole situation again. They connected me to the Payment Recovery Department. I was told to fax proof that I made my payments, which I did. I was told to call back in 24 hours.
I called Bank of America back the next day, and I explained the whole situation again. According to the online banking page, the problem was not fixed. The lady on the phone told me it was all fixed. The next day, I started receiving collection calls from Bank of America Home Loans. So I called Bank of America Home Loans again and explained the whole situation again.
This time, I asked to speak with a supervisor. The lady on the phone was very nice, and she seemed to be really knowledgeable. "Of course, Mrs. **, we will fix the problem and there are now late fees. Because you paid on time, I will take care of this right." On March 5, I received a collection letter from Bank of America, which was dated March 1. I called up Bank of America again, and I asked to speak with a supervisor, which I never was able to. The lady told me that her supervisor (Dereck **) would look into my file and call me back.
According to the loan modification agreement, once we started making the payments, the mortgage will be reported to the credit bureaus as being current.When I asked the lady to explain to me why it hasn't been done yet, she said to take 30 days. This is another question no one can answer. Dereck ** never called me back.
So I called the President/CEO Office of Bank of America. I explain the whole situation and got connected to Lorenz **. He told me he looked into my file and that he would take care of everything personally and call me back on March 2, 2010. He never called back. I called the President/CEO Office of Bank of America again. The lady connected me to someone else, and he said that Lorenz ** was in some outside house training, but he gave my file to Brad ** and that after he hangs up the phone, he is emailing him and they will take care of it. I emailed Brad ** myself. No response either.
I called the next day, March 11, 2010, and to my surprise, the answering machine of Brad ** said, "I accepted a new position with Bank of America and bla bla." I called the corporate office, and they connected me to a lady named Summer, and she said she will make sure that Brad calls me back when he comes in. He still has not called back.
I sent a fax to the president of Bank of America; no response either. And I filed a complaint with the OCC. I am very disappointed with Bank of America; even though they helped us with the mortgage modification, I am giving them an A+ for connecting people to different departments and an F for Customer Service. I hope that Bank of America takes note of this.

I had financial difficulties, and I was late in making my mortgage payments. As soon as I got the tax money, I made the mortgage payment, transferring the money through online banking, however they never posted the payment account. I called them several times, and they said that the payment will take time to be posted. They told me not to worry. I waited about 4 days, and I did another payment through online banking, and I called them, but this time, they said that my loan has been transferred to foreclosure. I borrowed money ,and I did two more payments in the banking center, and with that, I was current, but when I called them, they said that my loan is now in foreclosure. I told them I already did all the payments , and they told me, "I am sorry, but only if you do a modification can you get out of this, otherwise, you have to pay the reinstatement fee".
Today, I received a letter telling me I have to pay a total of 5 payments, and $800 for foreclosure attorney, plus $1,756 of some fees, for a total of $7,083.78, when I have already made four payments, two $848.78, and two of $849, and when I called again, they said the payments are not posted, and they have to research it and I have to fax the proof and I did. I have made all the payments, so I am current, and they took the money. The first transfer was on Feb 16 and the second transfer was on Feb 22, and later on the 23rd I did two cash payments directly at the Weston Commons bank. I feel that they just want to take my house.
They have the money from my payments, but they, on purpose, put me in foreclosure without even warning me or anything. They are harassing me, telling me that I didn't make the payments, and they are scaring me with foreclosure. I am a single mom, and I was unemployed for about a year. I am working now, and I did my payments, and they are not cooperating. They said the computer decides if the payments are posted or not, but nobody helps you, or post the payments, but they retain the money and accumulate the fees to scare you. Please help me. I don't want to lose my house. I have an 11 year old son, and this is our only shelter. I do not have money to pay for the foreclosure and attorney's fees amounting to $2556. I made my payment and they sent me to foreclosure on purpose.
Today is March 11, and when I called them, they said they have sent back the payments, but it's not true. They are keeping the money, and they are sending me to foreclosure, and I have been calling every day to try to solve it, but they don't know where the money from the payments is, and they just told me to wait, but I am afraid they are sending me to foreclosure. They said I cannot send less money than what they demand on the reinstatement letter, but they already have half of the money, and the rest is just the attorney's fees, foreclosure fee, and the late fee, but they have the payments, and if they don't return me the money, and don't post, what can I do? I did the first payment on Feb 16 and today is March 11. Almost a month, and they don't post or send me the money back. I am extremely nervous with a lot of stress because of this issue.

We put in the same offer again, and now, we are close to two months in the closing process. They promised closing by the 1st of March, and now that it is the 11th, these people are now filing an extension until the 17th for what they described as "a glitch" within the Bank of America system.
They have been informed that I have been incurring costs in a hotel and with a fully loaded 26-foot U-Haul truck that just sits in a neighbor's yard since the 1st of March. At this point, I need my medication locked deep in the truck and other things I cannot live without.
When trying to contact the person in charge in Woodland Hills, we got a runaround and nothing but lies. These people also had the balls to ask us where we got $100,000 in cash and actually stated, "How do we know you are not drug dealers?" This infuriated my self and the others working on this with me, as the money was documented and they did not ask us this question until well after all the requirements have been met and signed off on.
There is a sense of entitlement that BofA has here, which I can honestly say will end up in court once this is done. I have read many others who complained about these people, and I invite them to contact me to set up a class action lawsuit against BankofAmerica for the horrific business practices they are engaged in.
Perhaps, it is not enough that these punks got bailed out, but here they are hiring collection agencies and attorneys with the money--not loaning it out to you and me--and then treating people as though there are no laws to protect against crap like that. I beg to differ.
Notice to BofA: We are going to court over this, and it will be in small claims, so you cannot cower your way out of it with a slippery lawyer. See you in the next few months...

in the summer of 2009, I fell behind in our mortgage with BOA. It was Countrywide, but they were taken over by BOA. After catching up and reinstating the loan in January 2010, I received a letter from BOA that stated I only owed about half of my original mortgage payment for February 2010, because when I paid the loan current in January 2010, some of that monies was used for other things like fees, etc. and that I had a credit of $400 to use for February 2010.
When I called into to make the payment (I called 5 times over a period of a week.), no one from BOA would take the payment, and they said they had no idea where that letter came from, even though it was on BOA letterhead. During those 5 calls I made, I received 6 different amounts that I owe to BOA for February 2010.
Finally, on February 18, I spoke to a person in the Home Retention Department who said I owed $1200.25 for February 2010, and he would take that payment. I made the payment and received a confirmation number.
Yesterday, March 10, 2010, I received a call from BOA stating that I was behind on payments again, one for February and now march. I told them I had paid February and had the confirmation number. Manager Porshi ** told me that the payment I made did not cover the total amount due, therefore, they did not and would not post that payment I made. And it was sitting in their bank, pending as a credit for a partial payment.
I told her to that I did not owe any monies for February. Again, it was paid per the Home Retention team, and again, I had the confirmation number. She told me that it doesn't matter what the reps said and that it went by the written agreement, which would be the loan documents. I told her that was a scary thought that they could lie to me over the phone and say anything they wanted and tell me I was all current then hold those funds and then use that payment against me, hit my credit, saying I was late.
I faxed Porshi ** the letter stating I only owed $767.00 for February, even though I paid $1200.25 in February. After being told by Home Retention that I was current for February and that my payment would post within 3 days to the account, I found out yesterday that they never posted it to my account and they are using it to hit my credit scores for non-payment. Again, Porshi told me it didn't matter what they said over the phone and that its the written contracts they go by.
This morning at 7:08 (my time), my phone was ringing. As I was just getting up, I did not make it to answer the phone. Imagine my surprise when I called the number back and found that it was a BOA number. I am pretty sure that debt collectors are not allowed to call that early. And when I faxed over the letter stating I only owed $767 yesterday to Porshi, I also included what times I would be available over the next week. Today was not listed as available, as I have to work today.
This bank and these people are absolutely fraudulent. If I owned a business and I gave someone a receipt stamped paid in full and then 2 weeks later, I started hitting their credit for the bill they already paid and then told that customer "Well, that wasn't all that was due. You didn't pay it all," I would be sued and forced to eat that difference, considering they already have the paid-in-full receipt. How come BOA can do it?
BOA does everything they can to screw over their customers. They refuse to work with you, help you, and just don't give a flying peep about you. if we can't go by what the reps say on the phone, then why is BOA taking bailout monies and paying these ** to outright lie deliberately and get away with it? I am so disgusted with the lack of respect and absolute lies they have told me.
And yet, my credit is still being hit, as Porshi told me they are allowed to report non-payments to my credit. And again, she reminded me that I only paid a partial payment and that even if the rep told me I was current with that payment and took that payment and gave me a confirm numer, it still did not matter.
What's worse, even if I could refinance my loan (which I cannot, thanks to BOA constantly hitting my credit report and refusing to help me in the beginning when I was falling behind), I was not able to work with the new Home Retention team until after BOA put me into foreclosure, though I have requested them to do a loan modification for me during the entire summer of 2009. And even though I paid the loan current, they did not notify the foreclosure attorney, and a sale date was placed on my home and in the local paper as a notice, after I paid that loan current.
And if I was able to get a new bank to take my mortgage, there is nothing I can do when they sell it right back to BOA. So now, I sit with them holding my note on my house, and I cannot do anything about it. I am stuck paying these jerks for 25 more years. I tell everyone I know, not to use BOA for anything, as they are unscrupulous, fraudulent liars.

My home mortgage was transferred to Bank of America when the door of Taylor Bean & Whitaker were shut down. I have had nothing but problems and severe harassment from the employees and management of Bank of America. My first issue began when I received the new loan documents from Bank of America. To my surprise I owed more to them than I had originally borrowed and all my payments were non existent. I was assured that all issues would be fixed no later than September 2009 because they have to have all their records complete according to the Federal Housing Authority. This has still not been done.
My second issue was when I had taken my October house payment to a Redding Branch, it never posted to my account yet the funds cleared my bank. When I provided them with a copy of the endorsed check from my bank I received a notice stating that my August payment had not been made and yet it was done by phone and now they are stating that my February payment has not been made.
I have provided them with copies of all my payments and withdrawals from my bank account. I have not made one single payment late, yet I have had to pay late fees and I received approximately 5-8 threatening phone calls from them each day for 5 months now. I am not even able to complete my tax return because they have not sent me a true and correct 1098 showing all the payments I have made. I am going absolutely crazy with the ignorance and inability of Bank of America to keep their bookkeeping straight. I do not know who or where to turn to help get this matter resolved. My $1660 a month house payment may not seem like a lot of money to lose, but to me it is a fortune.
How could such a big financial institution not be able to find their errors and torment their customers at the same time? Something or someone needs to intervene in their business practices. I am going absolutely crazy and have spent many a nights unable to sleep., my phone rings 5-8 times a day for 5 months now. I am even unable to complete my taxes in a timely manner due to Bank of America. I have spent an ungodly amount of time on the phone and sending them proof of my payments.

I have a mortgage with Bank of America Home Loans Servicing, LP (formerly Countrywide Financial). I started falling behind in September 2009 because of a reduction of income and was able to make the full payment. I've been behind ever since and missed 2 months before I got back to a point where I was able to make full payments again. In January 2010, I spoke with Aaron and told him I was not able to make a full payment of $3,384.00 but was only able to make a payment of $3,000.00. He said that would be okay and I could send the difference next month. I have been misled by each person I spoke with at Bank of America. Each person gave a different story in that making partial payment was okay of it was not okay or that everything will be fine and not fine.
I come to find out that a partial payment was really not a good idea because the bank took my money, but did not post it to my loan until they had a full payment for that month. So each month, I would fall further behind. To make a long and horrible story short, I spoke with Vivian from Bank of America Home Loan Servicing on February 16, 2010 and spoke to her about my next payment arrangement. I told her that I do not want to lose my house and asked what I can do to save it. She seemed that most help so far and when I told her what I've been told before that they gave me misinformation, she said I should request for a loan modification, which I did. I faxed all the required documents (hardship letter, 2 months bank statements, 1 month wages and last year's tax return) on February 17, 2010 to the provided number. I was feeling a little more relieved.
I sent in my next payment and when I checked my bank account about a week later, the check has not cleared yet. So I called Bank of America on Saturday, March 6, 2010 and spoke with Shenisha and asked her if they received my payment. She said they did but that they are sending it back because my house is in foreclosure as of 3/2/2010. I was in shock. I could not believe what she had told me. I told that I sent in the documents for a loan modification on 2/17/2010 and that I was safe from foreclosure. She acknowledged that they received the documents but that it was being reviewed for accuracy and that the loan modification had not started yet, but it will soon.
I would think that when you are reviewing the documents, that starts the process. Was I lied to again? Is this normal business practice? What can I do to save my home or what are my options? Please help or direct me to where I should go to next. Because of the incorrect information given to me about my partial payment and the delay in the Loan Modification, my home is now in foreclosure. I think they did this intentionally.

I have a check from my insurance company issued to pay to repair my insurance covered claim on my home. My loan was taken over from Countrywide to BofA. I spent two hours on the phone on 03/08/2010 gathering information on the procedure needed for this signature. I was directed to a banking center in Medford. I live in Central Point.
I went into the center this morning and was unable to get the signature I needed. I was there about an hour and a half. I was finally told that the computer systems for the entire BofA banking system, nationwide, was unavailable. I was unable to get the signature I required and was told to come back another time. Is it the policy of BofA to withhold funds from their customers? I was told that it will depend on the status of my loan as to whether the signature will be given for my check. It is not in default. I am physically restricted due to injury and I do not go out very often. I need to pay the venders who performed the job and I see no reason that I can't get the signature for the insurance check and pay the bills due since the work was completed on February 12, 2010.

Well, since Countrywide sold the business to Bank Of America, my Bank of America mortgage somehow was linked to my Bank of America Bank accounts. I did not like this and I have called several times in the past three months to have it removed. I have been told no, it cannot be removed. Well, today my biggest fear arose. I paid my mortgage with online bill $3755.87. I am a little late playing catch up as always. Well, the online bill dept took over $7000 from my account.
When I called the mortgage company, they told me since my accounts are linked, they have the right to take any money from my account that's past due. Even if I had a zero balance which I only had enough to pay one payment for $3755. Now, my account is overdrawn $3700. The crazy thing is Bank of America mortgage took money from Bank of America checking, when there was no money there so they took an IOU from my checking account. This needs to be class action. Mortgage companies should not have access to our online banking resources even if it is the same bank without our signatures or prior authorization. Please contact me for more information.

I have been trying to refinance, since April 2009. Prior to BAC (Bank of America) it was Countrywide, and we had no problems with them. Now that it is BAC, I have gotten the same treatment as most of the others writing into this complaint forum. I sent all the documents they needed to review our case for a loan modification as a government approved refinance would raise our payment over $250. At first, they answered the phones, and stated it is in the process, no one assigned yet, wait a month, they are busy, etc.
I was continually being blown off, and for months now, I cant get anyone in that department. They won't provide any names to dial direct to anyone in the Hope Department. Even their phone service auto transfers you to customer service, which tells you that you need the Hope Dept, and around, and around you go nowhere. We have a first and a second, and we have had no issues with our auto transfer with our first, but continually each month, I have to call them on our second. Their system doesn't draft it. We get a charge, and rude customer service, of which, each one tells a different story of why it happened, including blaming us.
I can't believe they are still in business with how they practice. I decided to refinance for the government made affordable plan, at $250 more than we are paying to see, if we can squeeze out the payments, and received a 5.25 interest rate. The next day, a girl called to finalize everything, and quoted a 5.375 rate, and a larger increase in our payment. When I stated that it was not the rate agreed upon, even taped, she indicated that that is what it is, but would review and get back to me. She indicated something was wrong with their system, but it was the 5.375. I said I could definitely not afford that, and that I would like to cancel the refinance. They misrepresented the interest rate. It almost felt like a bait and switch. For the next month. I received calls from people, and automated messages to call them, regarding this loan.
They wanted to finalize it at the higher rate. Each time, I stated we were not continuing with the loan, because of the interest rate being misrepresented. Literally 5 or more a day, sometimes. Calls came in. I cannot stand the automated calls, and refused to answer those. Plus, the whole time, my husband is in the hospital, and I need my phone free for family. This really bothered me, that I had to deal with their **, at the same time my husband is fighting for his life. It is funny or ironic that I can't reach their Hope Dept, but they can harass me with their ineptitude and continued calls.
Now, I recently I received a letter, indicating they were denying the refinance, due to insufficient funds. I called on this as this was wrong, and I didn't want our credit score affected by this, and of course got nowhere. Then, they charged me for an appraisal we've never done! For the last four months, they have not gotten our payment auto-transferred, and I continue to have problems. I am switching our auto-pay from being requested by BAC, to having my bank send it to them. I do not have the time for their errors. I am very frustrated, tired, etc. Where is the help for us? All these banks are getting money to help us, funded by us through our taxes, yet no one is getting help. Can they just ignore me like they have, since April 2009?
It is sad that these banks are getting away with this. Doesn't the government see these websites with all the complaints? We will most likely lose our house, once our loans arm runs out this month. We don't know what variable rate it will become, and most likely, will not be able to pay it. Since my husband is still in the hospital, we are starting to receive some hospital bills ,which are over $12,000 at this point. Because of this, I don't have the time to deal with BAC, and doubt I would get anywhere further than I have, so giving up is all I can think of now, which is most likely what they want. I am tired of it all, and stressed beyond my limits. A refinance should not take close to a year. There should be accountability that the banks are using the money for what it was intended.

Bank of America sent me a notice last November that my flood insurance was short. I contacted my insurance company (State Farm) and had the insurance increased by the amount the bank requested. A month later, I received another notice stating they did not hear from me. I again sent them notice that the insurance was increased.
This has been going back and forth since November 2009. Now the bank is charging me extra, and I am paying more to State Farm. Bank of America refused to answer my queries. This is only costing about $84.00 extra annually--maybe not much--but it is an indication the BofA could cause me more problems in the future.

Refused to assist with mortgage help for 22 months straight. Never posted a notice of trustee sale anywhere on property ever. Never notified us after the sale with a 5-day notice to vacate. Changed the locks on the home while we still had personal property in the garage, less than 10 days after the trustee sale and were never sent any information on how to get to our things. We have received no communication whatsoever from Bank of America since the trustee sale on February 19th and assumed we now have no rights to the property or our personal property, since there is now a for sale sign in the front yard!

Bank of America was attempting to modify our loan for over 1 year. Around September 2009, Bank of America told us to pay trial payments and to stop paying our original mortgage payment. The trial payment was to begin in 90 days. I paid two months of trial payments and before I could pay the third trial payment.
On February 10th, they told us we were not approved. On February 17th, 7 DAYS LATER, they placed us in foreclosure and refused any more payments. It took over a year to tell us we don't qualify for a modification and in 7 days, we went from maybe getting a modification to foreclosure. They say we make enough to pay the primary mortgage but they don't take into account the Line of Credit my wife took out before we were married.
I tried to let them know I was making more money when I was serving in the military and now I was getting back to the civilian life and they didn't seem to care. I know this cannot be legal to go into foreclosure in 7 days especially when I was instructed not to pay the primary but to pay the trial Payments. Consequences are that they are going to put me (an Iraq War Veteran with Multiple deployments), my wife and my 3 kids out on the street. Way to go Bank of America after you survived with my tax dollars.

I had my home financed through Taylor Bean & Whittaker (TB&W). Once TB&W was closed down my mortgage was transferred to Bank of America (BOA). I have never missed a payment, or been late with a single penny that I owed on that home. As soon as BOA took control of my mortgage, I began getting harassed by them. BOA claimed they did not receive my Sept '09 payment (the first payment made to them). Furthermore, they accused me of being four months delinquent when they had only had my mortgage for one month.
Each month, I call and make a payment (confirmation number recorded) and each month I slip another month behind. Now, I am fighting foreclosure and it is no fault of mine. BOA representatives claim that it is just a "formality" and that the files will be corrected eventually. This has caused me negative credit scores (never had any issues in the past). They state that I can pay a rather large amount of money to correct the issue (which is not possible for me).

Taylor Bean Whittaker went out of business. Bank of America claims the escrow money in my account is "missing". The amount is about $1700. Bank of America has been no help whatsoever in recovering this money & instead, increased my payments to cover what they called a shortfall in my escrow account. I am currently in default on my loan with them & trying to do a modification. Bank of America got my hard earned tax dollars & was supposed be helping the consumers in my situation, i.e., laid off for 27 weeks in 2009.

I am trying to modify our 2nd home loan through Bank of America. I have had nothing but problems. First, I called in Oct of ‘09 to see if we could modify our 2nd mortgage. Customer service said yes and took my information and advised me to call back in 2 weeks for an update on the loan. I wait and call back. I was transferred 4 times until I get to a person who knows what they are talking about. Let alone, I am on hold for over 40 min through all this. This person now tells me we cannot modify our 2nd loan until our 1st mortgage is completed. I said why didn’t you tell me this in the first place? She says, "Sorry Ma’am.” I hang up.
I called my 1st lien holder through Citi. Got everything squared away no problem. On February 2010 1st, loan is modified. I call Bank of America back and was told yes we do modify 2nd loans if your 1st is completed, I said great what do you need so we can move forward. Bank of America says, “We need your 1st mortgage loan documents you signed for your modification proving it as modified,” I said ok. And I faxed it over. Two days later I call them back and said I faxed in a loan modification document for my first mortgage proving it was modified through CitiMortgage I need to make sure you received it.
Of course, the person I was speaking to didn’t know what I was talking about and said we don’t modify 2nd mortgages. I said yes you do ask your manager. So she did. I was right and she transferred me to a different department where this person couldn’t help me and this went on for about 20 min until I finally got someone who could just tell me the fax was received. She said yes we have it and your loan will be assigned to an outside counselor?! I thought that was wrong because the customer service rep in the 1st place who told me to fax the documents for the modification to get completed said all was done in house. So I said, “Ok well how long will this take?”
She said you will be notified in 30 days. I thought that was really wrong and called back the next day and I get the run around not only am I on hold to get someone on the phone (this is typical with Bank of America) like a 20 min wait each time your transferred). I get someone finally. I say I was told to wait 30 days but it didn’t sound correct so I am calling back to make sure I know when is going on with my 2nd loan to be modified and I faxed in all documents supporting the 1st was completed and need to know what steps to get this going. This person tells me, “I am sorry we don’t have a fax from you.” I said, “Are you kidding me?
The person I spoke to yesterday advised me they got the fax and the loan was assigned to an outside counselor and I will be contacted within 30 days to move forward.” This person says, “I am sorry but we do everything in-house and I need you to re fax this document.” I said, “Ok give me a fax.” He did and this fax was a completely different fax than the one I was given in the first place. I was so furious. Here I am trying to get this done and I am getting the run around by this bank that has the most uneducated home loan customer service reps I have ever dealt with.
Thank god, I worked in Mortgage for 7 years and know what I am talking about and up on exactly what is going on with my loans and how to deal with these people. So I ask for a manager. I got a manager on the phone. Let him know that this company has the most unprofessional customer service reps and each and every one of them needs to be educated and on the same page when it comes to helping their customers. The wait time needs to be no longer than 5 min. Bank of America needs some serious over hauling!

I have been working on modifying my loan for 1 year. The bank has lost my info, processed incorrectly and made constant bad/wrong moves which have resulted in me redoing my loan packet for the 3rd time. The whole time they have been reporting me as delinquent to creditors even though I have made all trial modification payments on time and my credit has been destroyed.
I am at my wits end and don’t know what else to do. My civilian income was cut in half and I am also part time Military. I want to keep my house but they are just playing games and a year later, nothing is getting done! I just faxed over all finance docs for the 3rd time today. Credit is destroyed and cannot refinance my vehicle (lease is up). I hold security clearance in Military and am about to lose that due to negligent credit reporting.

In the summer of 2008, we refinanced our home with Countrywide Finance. In December of 2008, they called and offered to do a loan modification because they had a better deal for us. So we went ahead with the loan modification and the deal was done, signed, notarized, and sent back by December 31st.
In early 2009, Countrywide sold our loan to Bank of America. When we received statements in January saying that we were behind on our payments, we called them and spoke to a man named Sheldon who informed us that the computer was just running behind and to ignore the statement and that when the computer catches up, it will show up and everything will be fine. The end of January, a woman named Mellisa called about past due payments. We told her about the new financing. She found it in her computer and said that she would fix it in the computer and it was okay.
We went on paying the amount that was specified in the loan modification. In may of 2009, we called again to inquire about why it was still showing up as late payments and spoke to a woman named Shontay. She told us that Bank of America now showed the old loan information in their computer. According to Shontay, they were not going to honor the loan modification made by Countrywide because there was a refinance and a loan modification in the same year and that it's not allowed. She transferred us to someone else who was going to help fix the problem. We were transferred to Jai who informed us that he would talk to someone in another department to see if they can recognize the loan modification and to just keep paying the amount specified.
We have since spoken to numerous customer service representatives; all who had different reasons for why they couldn't honor the loan modification, but none were willing to help us or transfer us to someone who could help us. We were just told over and over that the only way to fix it was to pay the past due amounts which by now is over $5000.
Me and my wife are both disabled and on fixed incomes. We don't have that kind of money and have no way of coming up with it. They have since destroyed our credit and are now threatening to foreclose on us. They continue to this day to take our money at the lower payment amount and continue to cash the checks but are totally unwilling to fix the loan modification or do anything to help us keep our house that we have lived in for over 15 years. We have acquired a legal aid lawyer to help us in our fight to keep our home. She, too, has gotten nowhere with them. She was just transferred from one person who can't or won't help and nobody seems to know how to fix this or wants to help fix this. It seems that they want nothing more than to foreclose and take our house.
This has destroyed our credit and kept us from doing anything to fix it among other things. Not to mention the stress put on my disabled wife and I. Now, she is stressed out to the point of nearing hospitalization. She has severe heart trouble and stress can cause serious problems with her. All over something that was supposed to help keep us from being stressed and strained financially. They never called us to tell us that there was a problem with the loan modification or that they wouldn't honor the loan modification that Countrywide had done. They just led us to believe that it was fine until it was too late for us to be able to fix it and then they refused to fix it for us. This is a bank bullying its customers and any help would be greatly appreciated.

I am the board president of Aragon Condominium Association in Addison, IL. I’m writing in regards to a fraudulent loan modification for a unit currently in foreclosure in our association. This unit was purchased in January 2007 for $239,900. The homeowner has never made a mortgage payment or association dues payment and now owes Aragon Association in excess of $10,000. We have done everything we legally can in order to collect these overdue fees. However, the Bank of America’s unwillingness to foreclose is costing our homeowners association $200 every month in addition to the $10,000 owed to us.
As part of our attempt to collect association fees owed, we had our attorneys do an asset search on the homeowner in June of 2009. The attorneys found absolutely no employment records, bank records, etc. In October 2009, we obtained an order of eviction as allowed by the State of Illinois so we could rent the unit to recoup the monies owed to us. The Dupage County Sheriff’s department and our property manager were present on the day of the eviction. When they gained entry to this unit, we found it had been completely stripped of everything and the homeowner had vacated the unit. The Village of Addison had already shut off the water service and posted a notice that the lender would be notified that the unit had been vacated.
We are unable to rent the unit because of its condition. And since October 2009, the foreclosure has been delayed five or six times, four of the delays taking place since January of 2010. As of 3/5/2010, this has been delayed again. We have contacted the attorneys for the lender Bank of America for the status of this foreclosure. We have been told repeatedly the reason for the delay is because they are working with the homeowner on a loan modification. We know this not possible. The unit has been vacated, is worth virtually nothing, and the homeowner does not and would not have qualified for a loan modification.
The lender is fraudulently claiming this mortgage falls under the loan modification program. We have every reason to believe Bank of America is intentionally stalling this foreclosure, so they will not have to assume responsibility for association fees and other costs associated with this property. These continued delays are costing our association a great deal of money and will continue to do so until this unit is foreclosed on. This unit accounts for more than 1/3 of our association debt. This was not the intention of the loan modification program. We are willing to provide all the documentation we have in regards to this matter. Please contact me or our property manager. The debt for this one foreclosure is now in excess of $10,000 and this will have to be passed on to the other 113 homeowners.

We did a refinance on our home in Sept/Oct 2008, and the mortgage was placed with a company called Taylor, Bean & Whitaker. On August 1, 2009, I mailed our payment to TB&W the first part of the month, because that is when it was due. On August 28, 2009, we received a letter from Bank of America stating we needed to send the August payment to them, as TB&W had been shut down, and they were assuming all of their loans. We explained to Bank of America that we had already made the August payment, and my bank payment showed the deduction from my bank account. We were told that this was not a problem, that it would take a couple of weeks to get everything straightened out, and not to worry about anything. We were told there would be no late charges, and it would not reflect on our credit.
Then, the phone calls started. We were being contacted by Bank of America sometimes 2-3 times a day, 2-4 times a week, and once, we would tell them about the TB&W situation, they would tell us not to worry, it would be about 10 more days before this could be fixed. There would be no late charges, no credit reporting, etc. We were told to continue to pay our original payment amount, even though the statement had a higher payment listed, because of late charges. This has gone on since September 1, 2009.
I have mailed proof of our August payment four times to Bank of America. I have faxed the same information twice. Every time, I receive letters back, stating that our proof (the copy of my bank statement) is not sufficient. The last time I mailed them copies of every payment from August until January, 2010. Last week, I received another letter saying they have received the proof or our payment, however, it is still not enough, and they would now like copies of all of my bank statements from August, until the present. Our monthly statement came yesterday, and it says our loan is now in default.
There are hundreds of dollars in late charges, and it is now saying we owe them over $2,800.00 in back payments. They are also saying that if we send our normal payment, it may be sent back. They want the full amount. We are never able to speak to the same person, or to anyone who seems to know anything about resolving this. We have been given bad phone numbers to call, bad addresses for correspondence, and even a name of a person I spoke to personally, who was not at that number when I called back. We have been harassed over and over. They called my husband at work repeatedly, even after being told not to contact him at work. At this point, we just don't know what to do. We worked so hard to fix our credit, and buy a home, and now because of this, we are about to lose everything. Any help on this would be greatly appreciated.
When we were younger, we didn't have such great credit. We worked very, very hard to fix our credit, so that we could buy our home. We have never missed a payment, and we have never been late on our payments. Our stress level is extremely high, because we are so worried about this. We can't sleep at night because we lay there worrying. And now, with this recent default comment on our statement, I am feeling very stressed, anxious, etc. I did check our credit report a month or so ago, and nothing had been reported.
In fact, Bank of America has not even reported the payments we've made. Also, our tax preparer says that what we've paid in interest for the year on our mortgage, and what Bank of America says we've paid are not accurate. He said that Bank of America is not reporting the full amount. I hope someone can help us.

As of March/April of 2009, I have been trying to work with my bank to assist me with a loan modification. I have received several different answers in regards to the modification program. I am on job disability. I have tried on several occasions to adjust my debt. When I follow the instruction to help me get the modification, I was given a different answer. I have given up my vehicle to reduce my debt, well as my utilities. Again, I was told I didn't have sufficient income. However, on their recording it was mentioned that my mortgage must be 31% of my income. It also states that they can assist if my income has changed due to loss of job or reduction in income. I believe that they are doing fraudulent mortgage practices. I need help please.

I have tried numerous times to get approved for the Obama mortgage relief plan. We were originally told we were approved. Our initial mortgage payment was 1049.00. Once we filed asking for assistance due to health and financial fall, we were never told what our new mortgage amount would be. We called weekly checking the status and every time we call, we were told that there were no notes or records of any of the conversations. Finally, after continued to push, we were told that a packet would be sent to our home and we need to sign and return. We completed everything Bank of America asked.
When we received our first coupon in the mail from the approval, our mortgage went from 1049.00 to 1349.00. We immediately called Bank of America and complained that we could not pay the 1049.00 and what made them think we could pay the 1349.00. Our loan went back into process for the Obama relief. We were told in December 2009, not to make any house payments and we would get a packet in the mail with our new mortgage amount. Since we this time around qualified for the Obama affordable home relief.
We continued to call every week to check the status and were continuously told the loan is still in process. We continued to call weekly and were told our packet would be mailed in February. The packet could be the 1st of February or the middle of February and at that time we will receive all of our new loan documents and the amount that we would be paying. A total amount was and could not be given due to the loan still in process. The week before February 1st, we called Bank of America. Again this was on a Thursday.
We were told at that time we no longer qualified for the Obama affordable home relieve and we needed to pay lump sum all funds that we are behind on. I informed them I did not understand how they can say that when we were told we were approved and each week we were told in process. The collection lady stated that myself and my co borrower needed to go out and each get a second job and maybe we would be able to pay our bills. My husband nor my health has been the greatest. The reason why we got behind in the first place is due to the end of 2008, I had 4 breast surgeries of which I was paying out of pocket a large sum of money for the surgeries. This tapped into our mortgage payment.
My husband has skin cancer of which his treatment for each visit is over 300.00. This is supposed to be paid up front. I spoke with Bank of America again on February 2 and was told that our house is being foreclosed on and is scheduled for auction on April 6, 2010. We were never received anything in the mail or received any phone calls. We are at a loss. We do not want to lose our house and we don't know what else we can do to keep our home. I spoke with an attorney today 3/3/2010 and was told since it is scheduled to be auctioned. There is nothing they can do.

Bank of America services my primary mortgage as well as my Home Equity Line Of Credit loan. I applied for loan modifications for both my mortgage and HELOC loan in June 2009. In September 2009, I completed the last of three trial payments for my HELOC loan, but never received final paperwork modifying my HELOC loan. No actions were ever taken by BoA to work out a modification on my mortgage. BoA assigned an employee, Yazmin **, to act as a negotiator for my mortgage modification application.
I have phoned and emailed Ms. T. almost daily since September of 2009 and still have no resolution regarding either of the loans that BoA services on my behalf. Sue L., an employee of the company that invested in my mortgage, Kaiser Federal Bank, has taken it upon herself to work with my directly to see if I qualify for a mortgage loan modification. She did this, despite the fact that her company retained BofA to service its loans because she, too, experienced repeated frustrations and non-action when dealing with Ms. T. and Ms. T.'s supervisor Kelly F., neither of whom return phone calls or emails.
I've contacted BofA's office of the President and CEO and spoke with Phil, Nancy C.'s office, Mari, Jason S., Noah, Tim E., Jose V. and Candace M. No one has been able to figure out why I've received no follow up since completing my 3 trial payments for my HELOC loan modification. They no longer even try to help me with my mortgage application since the investor is working directly with me. Everyone I speak with at BofA simply sends Ms. T. and her supervisor Kelly F. an email stating that the customer is trying to contact her/them. This has yielded 0 response from Ms. T. and, thus, I remain in a limbo that began 9 months ago when I initially applied for the loan modifications.
Bank of America's collection department calls me several times daily. I speak with someone in that department at least once daily. They have no record in the system of my having completed trial payments towards a loan modification. It's as if Bank of America's computers aren't linked and the various departments have no idea what's going on. Bank of America reports that I am behind in my payments every month to various credit reporting bureaus. My credit score is shot, which makes everything about this situation even more difficult.
The consequences are that Bank of America continues to report that I'm late with my payments and that I have a huge outstanding balance when, in fact, I make payments every month based on the amount of the trial payments. With my primary mortgage, they don't post the payments to my account, which is screwing up my tax filing records since they are not recording the massive amount of interest I'm paying on my mortgage monthly. Mortgage interest is, generally, tax deductible.
I'm unable to file my income taxes until this is straightened out. I receive harassing phone calls from Bank of America's collection department every single day. I answer these calls and explain my situation--that I'm in the process of being considered, supposedly, for loan modifications, that I've completed 3 trial payments on the HELOC loan modification, that I want to pay them, but I'm working with a negotiator to determine how much my payments are and, in the meantime, I continue to make payments based on my trial payment amounts.
The harassing phone calls continue multiple times daily. I spend at least 1 to 1-1/2 hours daily trying to work out the quagmire that is my mortgage and HELOC situation. I am losing income, sleep and peace of mind. I've gone on anti-depressants to deal with anxiety of not being able to get a response from Bank of America other than the harassing phone calls from the collection department. Harassing me might be understandable if I were trying to duck my payments. But I am honestly trying to be in integrity here. Get loan modifications, keep my home, get current with payments. Bank of America reports me as delinquent with my loan payments every month, which has killed what was once my excellent credit score.

The management in building A is very unprofessional and a ghetto. They give advice that they don't follow. They are loud, they go out, and eat for long periods of time. They talk about shopping and everything but the need of the employees. Richardson building A are all managers and they act like they have something to prove. They are very, very unprofessional. Helping people is the least important to them.

Bank of America received my account from TB&W. I was already in the middle of attempting to get this lender placed insurance straightened out when my loan was sent to BOA. I've called them every week to attempt to get this worked out. Long story short, I ended up in foreclosure while this was being "researched" with BOA Research Department. About 3 weeks before the foreclosure, some senior loan officer called me and asked me why I was 6 months behind on payments. I informed her I was not 6 months behind on payments.
She asked that I fax her "proof" of what I verbally told her and I did. It was the same information I faxed to Rhiannon ** in the Research Department when I was sent to foreclosure and the same information I faxed to Jennifer ** in Home Retention because she could not see what was in the Research Department’s. notes. Unfortunately, I did not hear back from her (Cynthia **) when I did call to see if she received my fax. She stated she was extremely busy and could I fax it again. I did. Still, no answer. I called the day before the foreclosure date and she informed me it was still in "Research".
I asked her what good would the research be if the sell date was for tomorrow? Her answer was, "Oh, it’s tomorrow?" Hold a moment. She came back and said she would have it (the foreclosure date) postponed and to call her back in 2 hours. I called back several times from my phone well after 2 hours. She did not answer. After one call, I immediately called back from another number and she answered. Once I gave her my name, she said, “Oh, I was just about to call you. I don't have an answer yet. Call me in an hour.” I told her I would have to file bankruptcy if I did not hear from her by 6.

My mortgage has always been on automatic payment draft from my checking account. I pay twice a month $338.00. In December 2009, I received a letter stating that my taxes had increased, and my drafts would now be $354.00 on the first and 15th beginning February 1, 2010. January 1, 2010, my regular payment of $338.00 drafted as it should have. However, on January 15, 2010, they drafted a payment of $354.00 instead of the $338.00; and it caused an overdraft in my checking account (my bill account).
I was charged a $35 fee. They drafted the increased amount early (January 2010 instead of February 1). As a result, they took me off automatic draft without my knowledge, then they called me from the collection department to tell me that my mortgage payment was short for the month of January 2010. Also, they did not post my January payment until February 2010. And I am yet to get my $35 overdraft fee back and was informed that a check would be issued to me. Keep in mind that my mortgage was not supposed to increase until February 2010.
I only found out that my automatic draft had been stopped in January, because my February 1, 2010 payment did not draft as it should have. Needless to say, I was upset because no one informed me. So on February 4, I called customer service at 1-800 and spoke with representative Kevin. He told me that I was taken off draft, because I had not paid the full amount in January and that since that has been corrected, he will set me back up on my automatic draft. He said he could take my payment over the phone for February 1, 2010, but it would be a $20 charge. After he discovered that I was upset, he waived the fee.
Then I asked Kevin if my draft for February 15, 2010 would come out as it should. He then stated that he would make sure that was set up as well. I said OK. I gave him all my checking account information again, even though it was in the system, because he stated he could not use that information. Now I'm upset, but I did provide the information.
My first draft for February that he took over the phone came out on February 5, 2010 for $358.00 (the amount that my mortgage was increased to beginning the month of February). I was uncertain if my draft for February 15, 2010 in the amount of $358.00 would come out as scheduled, so I called around February 8 or 9 to ensure Kevin had set everything up as he promised.
I got a rep on the phone and was informed "Ma'am, I don't see a draft scheduled to come out. He did not set this up, and we are going to need that payment for the month of February to ensure that you have a full payment." So now, I'm pissed.
They transferred me to a supervisor named Chaquita, and she looked and quoted the same thing. "Your draft is not set up, and we will need the second part of your payment to have you account up to date for this month. Let me set that up for you right now." So she asked for my information as well while continuing to apologize for the previous rep, Kevin, (on February 4, 2010) not setting up my automatic draft as he said he would. So now, I'm thinking this is an impotent system.
She also stated that the banks would be closed on February 15, 2010 for the President's day and assured me that the payment would post February 16, and I would not be charged a late fee. My mortgage is considered late after the 16th of each month. Well, I checked my checking account on February 17, and Bank of America drafted 2 payments, one for $358.00 and one for $365.42.This made a total of 3 drafts from my account instead of 2. Apparently, Kevin did actually set up the draft as he said, but no one could see that in the computer. Why not?!
Now, this caused me another overdraft fee in the amount of $70, because I was not expecting 2 drafts on the same day from Bank of America, because they had already received a payment on February 5, 2010. So I called, very, very, very upset. I was then informed they do see three drafts and would try to adjust that. However, they had not applied any of this money to my mortgage payment for the month of February 2010, and it was in "hold status." Why did they not post my money to my mortgage account?
I was placed on hold, and the representative checked with the Research Department. They supposedly applied enough money from the "hold" to my mortgage account for February, and I should be up to date. OK, now I'm thinking everything is OK. But I still need to get my money that I am owed plus the overdraft fees for January and February because of their error. I didn't get much success over the phone. I went to a Bank of America Branch on Elvis Presley Street on February 25, 2010, because the idiots still had not cleared my account and had not refunded my money.
The rep at the branch on Elvis Presley Bank of America spoke with a representative named Donnie and explained everything to him, and also, he faxed a statement from my checking account showing all this activity which included the overdrafts and the NSF fees as well as the fact that my mortgage is on automatic draft and has been paid on time.The representative at Bank America Branch on Elvis Presley told me to go back to my bank and sign an "unauthorized charge form," and I did.
My bank refunded my money and the fees on February 27, 2010. Donnie, at the mortgage company promised to call me daily until the mess is resolved, but he never called me ever. Yesterday, March 2, 2010, I spoke with a Brandy at the mortgage company, and she stated that my account is stating that I am 2 months behind on my mortgage. (Payment for February or March 2010 had not been received.) So now I am upset and mad.
She stated, "I see the three drafts, and I don't understand what is going on with this account." I told that apparently, neither does anyone else. She promised to call me today, March 3, 2010.
Last night, March 2, 2010, I received 2 calls from the collection department at 1-800-669-0102 stating that my mortgage is behind 2 months and I would continue to receive calls until my mortgage is up to date. I have also received at least 3 late payment charges on my account, even though it is on automatic draft. What is going on? I need help, and I am stressed. If I get a foreclosure notice, I and Bank of America have a problem.

We originally went to Countrywide and asked for a modification on our loan when we were beginning to have trouble. They didn't help us at all and told us not to make payments. One thing led to another or nothing and we were in foreclosure.
After dealing with what is now Bank of America for several months, they did a loan modification which brought my loan current, and was going to save my house and we thought it was a good idea. They dropped our rate down only from 6.25 to 6% and our payment was almost $100 higher than it originally was. Now, I went to make our first payment and they have adjusted our escrow or something and my payment has went up another $300. My payment originally was around $1100 and they now want $1500. I may have gotten my house out of foreclosure and its mine, for now, because if I couldn't afford $1100, how can I afford $1500. They didn't help me at all and I don't know what to do.
I may go back into foreclosure if I cannot get a real modification or restruction or lower rate or something. I cannot afford $1500.00 per month. I just want a real modification, lower rate, lower something. Please help.

I got laid off my job last year and I contacted Bank of America about a modification loan. They went through their series of questions and said I was pre qualified and told me I would receive a packet in 60-90 days and the delay was as a result of so many people applying for the same thing. I was patient. I waited for 90 days. I did not receive a packet. I called back to find out and to my horror they told me that there was no record that shows that I went through the pre qualifying questions. I told them to pull the calls because I know all calls are recorded. They said because I did not have the exact date they were not going to got through the calls.
In October, they asked me the same series of questions. Told me to wait for the packet in the mail. Up to this day, I have not received anything. I called over and over. Asked for a manager or a supervisor. They said they cannot transfer me but they will expedite my call and I will get a call in 7-10 days. They have expedited my calls about four times and I have never received not one call from a supervisor.
The reason I was trying to get into the program in the first place is because of loss of income and it is getting harder and harder for me to make my monthly payments but with the modification loan, it will help me. I had no idea trying to get help to save my house would take 8 months and still no help and no care in the world from BOA staff. Please help! I am drowning and BoA does not care! They would rather you go into foreclosure or go severely delinquent to get your attention.

Our new house closed and we were suddenly surprised the day after, that BoA had acquired our loan for the next 30-years. Well needless to say, we waited for the contact information and new address to begin sending our payments. Upon numerous inquiries both via computer and phone we got an address "verbally" and sent the check over night. It was signed for (at BAC) and we thought all was well. After two weeks from the due date a debt collector called saying we hadn't paid yet and that we need to call BAC and discuss our options.
To make a long story short, we then decided to pay over the phone and request a stop payment from our bank (Not BoA)on the first issued check and considered the it lost (on their end). The assistant taking my bank information to complete the phone transaction received all the proper stuff to confirm that the account was valid and gave me a confirmation number at the end of the conversation. Then an additional week went by and calls started with the dept collecting department again, stating they hadn't received our first payment.
So the third time (a charm), my wife went through the same ordeal and submitted another phone payment with the fee waived and confirmation occurred just before our second payment was due. As of today we paid the second payment via their web site and it has yet to clear. So time will tell if we go through this again. In the meantime we are fighting the late payments they promised would not follow, as again it is their fault. Stay tune for the next installment within this on going saga of how BAC shows their incompetence.

I just signed on Tuesday for the home modification on my loan with Bank of America. I signed out of fear that if I didn't I would get nothing. It has taken me since March '09 to get this. They did lower my interest rate from 5.875 % (adj rate) to 3.625% for five years then 4.625% for one year then 4.875%. I was told by someone on the phone that they used my gross income in the place of my net income (I have a first name only) and said my only option if I did not agree was to let the time on this offer to expire and start the process over. I was afraid to do that.
They've added charges to my loan without documentation of the charges. I have had two trial periods and the final is even more. They did not offer a fixed mortgage. I was told but have no proof that they used my gross income in place of my net income. This is the second time that has happened.

I lost my job on 1/8/09. I immediately contacted TBW who serviced my mortgage at the time. They approved me for a forbearance plan. In the meantime, I put my house on the market in a short sale. I made every payment on time as agreed with TBW. An individual signed a contract (short sale) on my home on 6/29/09 who was a pre-approved buyer. Then TBW was shut down by the Federal Government in July. The first notification that I received from BOA Home Loans on 9/3/09 (who took over my loan) notified me that my home would be foreclosed on.
All documents pertaining to sale were faxed to the short sale dept on the same day. BOA Home Loans has continuously lost all paperwork (47 pages) pertaining to the contract, HUD1 etc. in spite of it being faxed 14 times and mailed certified. Between my realtor and me, we made verbal and written contact w/ them at least once a week to get nothing but the run around. To make a long story short, they notified me in early February 2010 that my home was set to be foreclosed on 3/2/10. I had to file Chapter 7 bankruptcy to protect my belongings until they could be removed from the property.
Including the down payment on my home and all payments made I have lost almost $130,000.00 and have no home. The purchase price was $156,900.00. I have suffered a huge financial loss. I can't begin to explain the emotional, mental and physical damage I have suffered from their neglect, disorganization, untimely process and unnecessary foreclosure proceedings.

The problem is I made my August 2009 mortgage payment to TB&W but they apparently did not forward the August payment to BOA. BOA has been harassing me for that same payment to the point of threatening foreclosure, garnishing of VA benefits, negative credit reports, numerous threatening phone calls, etc. When I speak with the BOA customer reps, they, in a very professional tone, acknowledge they are wrong, and that their system simply has to catch up (something supposed to have happened by end of October 2009).
But, the matter has apparently gone to their collections and I continue to get threatening letters and phone calls. I have sent them on numerous occasions copies documenting my payments to TB&W from June 2009 through August 2009, and to BOA from September 2009 to the present, and have all documents to reflect that I am up to date.

Due to financial and personal difficulties, I was having trouble making my mortgage payment. In August of 2009, I contacted my mortgage holder, Bank of America, to start the mortgage modification process in order to lower my payments and avoid foreclosure. I was told to provide certain documents and the process was started. I sent the requested documents, and began making the new modified mortgage payment. Then, the process began of a series of calls and letters from BOA.
I was informed that I needed additional documents, and that others had not been received. Somehow, some of the paperwork in the package managed to reach them, but some of it disappeared. This process occurred three times. I sent more copies of the same documents and then would either get a call or letter that only some had been received or that they were incomplete. All this was occurring even though I sent exactly what was requested over and over. Then came the letter from BOA that they had "inspected" my property and it was found to be vacant. I was notified that they would be notifying my homeowners insurance company of this information and if it was incorrect, to please call customer service. I did call - immediately. I explained that I had lived here for 21 years and it had never been vacant. I haven't even been on vacation in years. I was told that they would order a reinspection and it had better look like I lived there.
I live on a mountain. A GPS tracking system will tell you that you are here when you are halfway down the dirt road to my house. Three homes near me have been foreclosed and are vacant, but mine is not and has never been. I also have my house number on the house. I have fully explained all this to BOA, and they "made a note of it". Well, the reinspection report indicated that they couldn't tell if someone lived here or not. Again, I think they never came all the way to my house.
I now have a notice from my homeowners insurance that I have been cancelled due to the property being vacant. They were notified of this situation by BOA. I have now also gotten a notice from my mortgage insurance company that it has been cancelled due to lack of payment. Apparently when I entered the modification program, they quit paying the mortgage insurance. I was told by customer service that they would only pay homeowners and taxes to protect them as the lien holder. Of course, I just received the notice that the mortgage insurance had been cancelled. Imagine if I had died?
Today I was on the phone for a total of 6 hours with one department or another at BOA trying to get at least one part of what is left of my mortgage straightened out. I have been angry, frustrated, and in tears. Last Wednesday I received a Fed Ex package from BOA. The letter inside said I was still missing documents and they had to be there by Feb. 27 or my modification would not go through. I have been on the phone all day and have only been told that the Fed Ex package did arrive, but they were too busy to tell me if the documents were received.
Someone did finally tell me that a review on my file dated today indicates that documents (but not which ones) are still missing and my modification is not done. I have done every single thing that was required of me before any deadline that was given, yet somehow my mortgage has turned into this nightmare. I have played by their rules and yet this is the result. The economic consequences of this are tremendous. I am currently considered "in default" on my mortgage, even though I am in the modification program. If they decide to deny my modification due to "incomplete documents", I will have to come up with the difference in the modified payments that have been made and the amount that was originally due. If not, then I may lose my home.

I fell behind on my mortgage payments and was in threat of going into foreclosure. I came up with the missed payments and contacted Bank of America to let them know I would be sending the payments in full. I was informed that I had to order a reinstatement quote and to call back in three days. I called back as instructed and was told by someone else that no quote had been ordered. I asked her to order another one and she said she would and for me to call back in a few days. Once again I called back and no quote.
Now understand that I couldn't pay my loan until these figures came in, so time is steadily elapsing. Long story short, that was one month ago and all I'm trying to do is find out how much I owe with the reinstatement fees added to my loan and pay! I have gotten the runaround on every end and I am afraid I may lose my home because of this.

I told Taylor Bean, my old lender my father in law was dying and we were going to fall behind. At the same time, my husband lost all his over time and not less than two months later, I was given a $600 a month pay cut. Bank of America bought our loan in July, 2009. I sent all materials over and over again, was denied twice. The first time was for insufficient income. They told me to get another job. The second time they asked me my race, then declined me. The VA got involved and found out that they had gotten my expenses wrong through a typo so they re-sent them the correct info. In that time, I got served with a foreclosure and at the same time Bank of America send me a letter saying to continue to make payments while my loan was in modification. I sent in two payments, they got sent back.
I’ve called my Congressman, been on the news, sent my case to the Florida Attorney General’s office, HUD. I’m still losing my house even though we qualify for the Making Homes Affordable program that seems to be a total load of crap. I’m working my butt off with two jobs and we have no extra bills other than mortgage and car payment. I’ve been putting the money away that they have returned. Originally, they wanted half down what I owed them. Then they still declined me, told me to go to my church, family members and borrow the money or sell one of my cars. How would I get to my two jobs I’ve had to get to qualify? Anyhow, they keep putting me off, saying they are reviewing it. After two denials, I am not optimistic. If I let this go in front of a judge, they'll be in big trouble. They never even served my husband with the foreclosure and the loan is in his name.

After having my information for over a month and asking for a pre-approval for a home loan, he took his own time to produce this document. Even with changing the type of loan to VA which would be easier since my disability became higher, it took too long for him to complete the papers. The home we wanted to buy already had an offer made out, was put under contract to someone else at a lower price than what my offer was because of the inaction or slowness of this man.

I have my mortgage through Bank of America. With the economy and other issues, I got a month behind. I called them to try and work out something with customer service. They refuse to work with me. So I decided to make extra on my payments. 1st so this will take care of my late payments and another I was thinking it would take some off of my past due bill. Then in November 2009, I received a letter stating that I owe 2200.00 (give or take a few dollars). By the way, my payments are 792.00 a month.
I then called up customer service and they agreed to send me a letter with my payments. Each month during 2009, I paid extra on my mortgage payments. Again, for late payments, and I was hoping they would apply it to my late payment. But reading the statement, they did neither. They kept adding late payments. I was paying from 850.00 to 900.00 each month. So I got on the phone with them and spent about two hours with a Myra on the phone. She could not explain to me where this extra money went and why I was still receiving a charge for late payments and that she could not help me, but she would get in touch with me the next day.
The next day went by, no phone call. The next week, I received a call on when my next payment was going to be made. I just made one the week before and I asked him Myra was suppose to be calling me back. He told me that I had to call customer service and I did. This time I talked to Cassandra and we went through the same. It has been going on like this for a few months, and no one can tell me where that money went. It was about 700.00 extra dollars. I received a letter Friday, Feb. 26, 2010. Stating the payment will have to be made by March 19. I just want the extra money to be applied to my late payment. Where has it gone? I have paperwork from my bank where I made the payments and from their bank where just the minimum payment showed up. What do I do? Who do I contact?

I have been trying to modify my mortgage for well over a year now. I was told by the HOPE program that I qualified to modify my loan. After sending the documents to Bank of America 5 times now at my cost, I was told that I had to have my soon-to-be ex-husband sign the papers as to we were still legally married. But when I called them, they told me he didn't have to sign them so I mailed them in. 5 days later, I got a foreclosure notice on the house stating that now, I was severely behind on my mortgage and he didn't sign the papers so I was denied again. I immediately called about the foreclosure notice and they then told me I wasn't supposed to get that, that I was in process for another program.
I then got a notice from their attorney with a foreclosure notice stating that they intend on foreclosing on the house on April 1st. All the payments I have sent them since the notice were returned to me after the federal HOPE program told me to send them all I could until the papers went through. I again called Bank of America and was told now I don't qualify for any of their programs because my income is under limits and this is after they informed me not to pay any of my credit cards or etc. but them. Yet now they sent me another package of forms to photocopy and send to them at my cost, still with my now ex-husband's name on them.
I called them again. They told me to send the final divorce papers which was just finalized as of Feb. 23rd. The papers needed to be back to them by the 20th of Feb. Also, I called them back in July to see why my mortgage went up and they processed a phone payment on the automated system without my permission to do so, when I just made a payment to them using their website. The payment on their automated system made everything in my checkbook bounce along with the online payment. I sent them proof of what they had done and was told they aren't responsible for anything that was done on their website, so they refused to refund me any of overdraft fees then proceeded to charge me an additional $225.00 in overdraft fees and late fees for the online payment being NSF.
I just don't know anymore where to turn. According to the Obama Making Homes More Affordable program, I qualify. According to HUD, FHA and the HOPE program, I qualify. Bank of America says I don't qualify for anything and they are just going to foreclose on the property. Mind you, since I took my mortgage through FHA/HUD, I have kept PMI on my mortgage.

I short-paid my December mortgage by $420.00 due to some problems that occurred with my house, repairs, etc. Then my car broke down--various things that caused financial problems. I have since been overpaying my mortgage to catch up the amount due ($420.00); my mortgage payment is $1,420.00. In January, I paid $1,600.00, and in February, I paid $1,575.00 with the intent to catch it up in March. I pulled my credit report, and Bank of America reported that my January full mortgage payment is 60 days overdue, which is not correct.
I also received a letter that basically said that my loan is in jeopardy of being in default. I spoke with (2) different employees at BAC; both told me different amounts were due to catch up my payment. In 4 years, this is only the 2nd time I've had an issue making a payment. I made a payment of $185.00 this morning. I'm not sure if that will straighten it out, considering that I'm not sure what the true amount due is. My question is do I have any recourse on getting this item taken off my credit report? Is there no leniency for consumers that do everything they can to make their payments on time? And if honestly run into a problem, we're not given even the slightest break. Without even thinking, they just ruin your credit.
In this economy, your credit report can jeopardize getting/holding a job, etc. I find it hard to believe that these large corporations don't have any compassion at all for those of us who try and do the right thing. So why should we, when something happens that could not be prevented, not be understood? They don't try and work with you.

I filed a Chapter 7 bankruptcy with Countrywide Mortgage because I could never get anyone to work with me on a restructuring. I have banked with BOA for 10 years when suddenly, a mortgage amount for the amount of my Countrywide mortgage plus $35,000 shows up as a current BOA mortgage! I called dozens of times and was finally told that BOA bought Countrywide and they were simply processing their files and the house was still in foreclosure.
I explained to them the bankruptcy discharge that I'm on disability and that I considered this harassment. I was told this would be removed immediately. Three months later, I write BOA and I'm told I need to complain to the Comptroller, not the FDIC. Now, I'm writing to BOA, the Attorney General, the Comptroller and my bankruptcy attorney because the amount shows up on my online account every time I log in to do my banking.
It's harassment! I'm scared to death, they are going to try to hold me to this debt somehow. How can they do this? Emotionally, mentally, and physically drained, stressed, harassed by someone hounding me for over $300,000 for a debt. I don't even owe them! My health is suffering. Not to mention what it's continuing to do to my credit.

I have been dealing with the home retention team for close to a year before we fell behind on payments during and up to now and all I have gotten is attitudes. My last encounter with them was on February 26, 2010 after being on the phone for close to an hour. "Marie" answers the phone and the first question out of her mouth was, "Are you making a payment?" When my answer was no, I got a long sigh from her, almost as if it was a frustration for her.
After that, "Ivan" gets on the phone and the same thing, he kept telling me how he didn't understand my question. How hard was it to understand, "I received a letter from Bank of America that said my insurance was going to change my insurance is impounded through my loan. Could you tell me who is holding my flood insurance and my homeowners insurance?" I lost my cool and asked Mr. I. if he was a homeowner? When his response was no, I told him that he did not know what it was like to be in the process of losing your home and seeing the numbers on the property drop so drastically.
At the end, I think he understood my point of view but I have received no help from bank of America with the modification of my loan and the home retention team is no help in giving you hope. I am a banker at Wells Fargo Bank and was previously employed for three years by B of A and I know that all people have now a days is to see some hope and light at the end of the tunnel. Sad to see their customers service has dropped so significantly. I don't know what will happen with my loan but I sure don't want to lose our home.

Bank of America sent my second loan that was guaranteed by the house and plans to do the same with the line of credit account that was guaranteed by the house, which value decrease more than 50%. I had been dealing with a divorce and ended with nothing by debt. The house was on short sale and now is on foreclosure proceedings. Is this legal at all? The house is still there, but I have not been able to make payments due to financial hardship. Thank You.

On Monday, February 22, 2010, I went to my personal bank, HSBC, and asked them to wire funds to pay off my Bank of America mortgage. On Wednesday, I called Bank of America Customer Service and they told me twice that my funds were not received. B of A asked me to fax the details of the wire funds transfer on HSBC Bank letterhead. I gave customer service my Fed Wire Number of the wire transfer. I sent numerous emails with replies telling me I needed to call back. On Wednesday night, my internet access to my account was blocked.
On Thursday morning, I called Customer Service, I hoped for the last time and was told my wire transfer was effective Monday February 22, 2010. Maybe Customer Service could have handled this better by merely telling me to wait 3 days for the wire transfer to be shown on their computers. Bank of America does not communicate via email at all; they prefer to talk with you on the phone, probably fearing anything they may put in writing. There was no financial damage, just a mad scramble of phone calls to document the funds were transferred properly.

I have been trying to get a loan modification since it was first announced in March 2009. I have been passed from person to person and have a thick file folder of notes. I was verbally given a loan modification amount and told the paperwork would be delivered at the latest Dec. 27, 2009. It is Feb. 25, 2010 and still there is no paperwork. We are going to end up losing this home if it isn't modified.

I have been sending letters and requesting in writing for months and months the paperwork necessary to do my 3-month trial, so I can get my modification that I've already qualified for. I've sent in the requested information several times and can't get any cooperation from them. They are dragging this along, and I'm losing my patience.
I know for a fact that there are others in my county that have already done their 3-month trials and received their modification packages. One person got a 3% interest rate with the past due amount forgiven; the other got a 4% interest rate with the loan extended to 40 years and had all the past due put at the end of the loan. I don't understand why others can get results, but they just keep putting me off! Evidently, I'm not making enough noise.

I have been trying to get the modification loan (hopeforhomeowners), the new law and funded by US tax payers which these banks got all the billions of dollars, well Bank of America is got to be the worst of the worst to get any info from. I have spoken to over at least 30 people since I have started the process, and no one knows what is going on there,
they keep giving me excuse after excuse that they are waiting for a person to be designated to my claim, well 3 weeks ago I received this letter from them they the person on the letter if I were to call her would have all the info I need about my case, well for 3 weeks now I have called diligently each day leaving message after message and she has not tried to contact me once.
I have reported them to the OCC, my congresswoman, my senator, my governor, and it only seems that my congresswoman is the only person to reply to my emails or calls, so what does that tell you, our government does not either care or have any answers, or cannot be bothered to help us in need. Meanwhile I am closer to losing my house that I worked so hard for and to keep. But what the hack do the politicians or government or even the banks really care, think not, banks just want their bonuses, which the government keeps letting them have. Very upset tax payer. Hardship with husband, stress, headaches, unable to sleep, cannot afford to buy enough food, worried about mortgage payment etc.

Atlantic Coast Title Company is having major problems with the payoff department. Here are the following issues: 1) The bank's incoming fax line for payoff requests seems to be sporadically down. 2) When calling into the payoff department, they will instruct you again to submit the authorization, take down the information to do that over the phone and states the request is in their system to be generated and faxed.
Promises, promises because that never happens and when you call for an updated, after having been on the phone for over an hour, and I'm being generous, they find nothing in the system and the process starts over again. Apparently, there is an internal problem that is not a priority within the payoff department and no urgency to be rectified. Question is what are you doing about this problem and when can everyone expect some resolution? I don't need to have an attorney contact me as we have a residential attorney here at Atlantic Coast Title Company. I would like a response asap.

I applied for a home loan mod in Aug 2009, Oct 2009, Jan 2010, Feb 2010 and never received anything. I called them for the 10th time on Feb 23rd 2010 and they told me I didn't qualify because my existing interest rate was too low to adjust the payments. If that's true why the ** didn't they tell me that in August of 09. They led me on for 7 months or are just taking the money and putting it in their pockets like all the other fat cats in this country. I'm losing the house i built myself!

After falling behind in my mortgage 4 months, I was placed in foreclosure. I was told earlier to send a payment and I would avoid foreclosure, so I did. Even after that payment, I was placed in foreclosure. I called the bank and they said to request a reinstatement figure, so I did. After getting the reinstatement figure, I was told that the loan would get reinstated partially so I cashed my CD and sent half of the payment. When I called to verify, they advised me that I need to send all. They have lied to me in two occasions. Their reps on the phone don't know the right from the left. One says one thing and when you call back thinking you have a plan, the next rep said whatever they told me was incorrect. I have been waiting for a call for the modification papers I sent them last year. All they can say is "we're still reviewing." I'm in foreclosure on my primary home.

I have contacted Bank of America twice trying to obtain a modification loan as my house payment is way too high; I sent in a letter of hardship. I contacted the Executive offices of Bank of America last week. I was told the name of a lady Eliz ** (sp) who was supposedly handling my loan. Yet, to date nothing has been done. I cannot get anyone on the phone. I only make it to the hold button and then nothing happens. Meanwhile, I am 1 month past due and cannot make February mortgage. The house payment is out of control for the decreased value of my home in Cleveland. I would like to obtain help and I am getting very frustrated with the lack of cooperation. I should appreciate the courtesy of someone to call me so I can get out from under an anxiety pit of worry over this matter.

I am sending this letter in an effort to get someone to hear my complaints regarding your Home Retention process at Bank of America. After 2 years of communication and monthly calls to Bank of America, I was approved for a Hope for Homeowners Modification in August 2009, received a Modification Agreement, which was supposed to be returned by September 22, 2009. Attached please find a copy of the Modification Agreement that we signed, notarized and returned on September 4, 2009.
After speaking with a man in the Hope Team, he advised that the Modification was to be effective on 11/1/09 and that the September and October 2009 payments were included in the modification and not to make them since it would change the modification calculations. I was to start making payments in the amount of $2269.03 effective 11/1/09. I have made the 11/1/09, 12/1/09 and 1/1/10 and 2/1/10 payments. Appears that because the system changes have not been made all of the payments were put in suspense. They were posted as a regular pre-modification payment for September and October. I do not see that the February payment has been posted yet.
I did get another modification agreement via FedEx in late September from your regular Home Retention Team. When I called in about it, I was told to disregard since I had already accepted the Hope for Homeowner Modification. I told them that the Hope for Homeowners Modification had better terms anyways. I have been receiving collection calls for the last 5 months. When I explained that I have already been approved for a modification, I was told "Oh yes, I see that, looks like we are waiting to make the payment changes. I will document the account."
Today I got a collection call and the lady told me that there is no active workout on my loan, that the modification was canceled because I rejected it. I told her to look again since I am waiting for system changes on the Hope for Homeowners Modification. She said she could not see anything on it, that I was $11K delinquent, and if I wanted the HUD number. I was told that she does see where I called in and asked for the system to be fixed, the issue was escalated to management on 1/28/10, 2/12/10 and most recently 2/18/10. I was told to keep calling back because there is no assurance this will get looked at.
I understand that the volume of modifications must be great but I do not understand not coding the system to get the system changes done, stop collection calls and stop derogatory credit reporting. Please note that I have been notified by the Credit Bureaus that Bank of America has submitted derogatory reporting since September 2009. I understand by the Hope Now Team that this will be corrected and all derogatory reporting will be eliminated from my profile. This is impeding my ability to get any credit. I recently had a car accident which totaled my car and cannot buy a new one because of the derogatory credit on file.
I have been sending letters since October with absolutely no response. I need this corrected immediately. I need a call back confirmation the above and when the changes will be completed. I am unable to get credit due to the derogatory reported by BofA. I was never once late with a payment prior to this process. I am stressed and physically sick because of it. I work in the industry and I am concerned that anyone will find out I am delinquent on my mortgage when I am not. Thank you for all of your assistance in this matter.

I was contacted to do a re-finance of my loan in the beginning of December. I sent all of my paperwork in by December 22nd 2009 and was told that I would be closing the end of January 2010. On Jan 18th 2010, I was told via email that a mistake had been made by Countrywide (which Bank of America now owns) and a 3rd lien had been filed against my home. I was told this would take "two weeks or more to fix". The submission to fix the issue was not turned in for another 10 days (28th of Jan) and when I discovered this, I contacted my loan officer again. He stated, "The title company wasn't sure how to handle it but now they are working on it." I was like, "What? Isn't that their job?"
I am now getting the runaround about when the error will be corrected. In the mean time, I was charged $400 to "lock in a rate" back in December, one that obviously has never come in to play. I am now being told that the "title dept and reconveyance dept" has no way to contact them by phone so my loan officer can only email them. I find that outrageous! I have also been told, "Well, we will get your closing costs reduced, but again, not sure when we are even going to be able to close your loan due to this error." I have been told that I cannot even sell my home if I want since it shows three liens instead of two. This is very upsetting. It has gotten to the point that my emails are not even answered.

I have filed papers for to prevent foreclosure as it was advertised on the Radio by Attorney general Michael ** I completed all papers with Ms. Carmen ** at Southwest Housing-SWSOl.org. As per received letter stating all papers has been submitted by them to Bank of America and they have given me the phone # as my Lenders contact #.
I have tried numerous times to contact them. However, I have been unsuccessful. I have also emailed Ms. ** at the email address provided on the letter- she has told me that she will get back with me later. Also, I have been trying to call her, left messages also but no response. Now, it's almost 9 months and still do not get any response from her or the Lender.
Finally, I just got hold of her on 2/19/10 and she told me that I will have to restart all over again. I need help. I have been laid off since 11/23/08. If there is no more extension for UCB. I don't know how I will survive. I have taken all steps to prevent foreclosure but I have not received any help from OBAMAs plan. Please help me in my situation.

For 1 year now, I have been trying to modify my mortgage under the Obama new law, and have always got the runaround from everyone I have talked to there. There are over 35 people; no one knows what they are doing there. I contacted every politician here, the OCC, and now you people. I recently got a letter from them with a name and telephone number to someone there to talk to because they have all the info. I need. Well, for 3 weeks now, I have called them numerous times, which I have proof of, and that person has not called me back or tried to contact me. Her name is Fernanda **. She has ignored my calls. Please feel free to do whatever it takes to get this matter taken care of as I am in need of help with these people. They are ignorant, not informative. They just play games with me for the past year and I am getting very sick of it. Losing my home to them is unacceptable to me. They are supposed to help us, not play with us. Thank you.

Bank of America has owned my mortgage from its inception in 1990. I refinanced in 1992 for a better rate. In 2007, I refinanced again, but this time out of the need to leverage equity in my home. In 20 years, I've never been late with my mortgage payment, but have experienced significant income fluctuations. As a small business owner, my household and business operating revenue has been significantly impacted. Nonetheless, I've made sacrifices (going into savings and retirement) to keep my mortgage current, in order to prevent being late or in a foreclosure situation.
As a sole income provider, my home is very important to me. I'd been keeping abreast of the mortgage modification programs, and sought the consideration of Bank of America beginning on the first quarter of 2009. In April, I was told by a Bank of America mortgage specialist that the only way to be considered was to intentionally default my payment. ("You will have to miss making your payment for us to even look at your accounts.") I told her I was not comfortable defaulting on my payments, in that, all the sacrifices I've made all these years has been to keep my credit in good standing.
Finally, in September, a consultant at Syracuse University was in Charlotte conducting an "on the ground" study of the impact of the mortgage industry. I was encouraged to contact her, and after discussing my dilemma, she told me modification rules have changed to include income changes. A mortgage payment should not be more than 30% of the individual’s monthly income. Like the persons in the Ohio Class Action Suit, I once again contacted Bank of America Mortgage and having access to all my financial accounts (checking, savings, credit cards, mortgage, home equity and small business), they could see my household income had been significantly impacted and stated I would qualify for the modification and they gave me a reduced interest rate and bottom line monthly rate that was supposed to take effect immediately, upon receipt of the remittance coupons for a three-month period while I awaited the application. Upon signature and submission of financials, it was to be officially processed.
Weeks went by and I did not receive the paperwork. After numerous calls and being on the phone for hours at a time, I went on to conduct other business. Finally, two months later, I received a call from FedEx saying they need my address to deliver a document. Bank of America had placed the "wrong" property address on the package. I received the mortgage modification papers, but this "huge" error was major significance. Bank of America issued this 1 inch application with my name, social security assigned to someone else's address (which was approximately 1/2 mile from my house).
I contacted the mortgage department once again to tell them about the error and that I was reluctant to sign this paperwork, in that my name is associated with someone else's property. They promised to resend the corrected paper work (in November), and I've yet to receive the paperwork. The reduced interest rate would have benefited me approximately $170 per month savings, and still no follow up. After four attempts to contact them, being on hold on a perpetual call-wait system, I'd systematically be disconnected. Hence, I continued to pay on my current 15 yr- Conventional mortgage at the original rate, and in fact, I am presently paid up a month in advance.
While conducting some online banking today, I noticed my two Bank of America credit card limits had been reduced dramatically from $8,000 and $23,000 to $500.00. I was in shock. When calling the credit card company, the credit underwriter told me the reason my credit limit has been reduced was because the mortgage company reported that they have written off a portion of my mortgage because I had enrolled in the Making Homes Affordable program. Just a month ago, I checked my credit score and history and had a 799 credit score, with no adverse activity. The underwriter noted that my credit score is now significantly lower, and as a result, so was my credit limit.
I have been a 20-year customer of Bank of America, holding all of my business accounts. How dare they foul up my paper work, place my name on someone's property, and report me for refusal to pay on this property and worse, and charge off for a reduced mortgage that I never actually received benefit from, especially when they have no signature of mine reflecting any acceptance of financial terms.
Failure to disclose full terms: Bank of America does not tell its customers that if they apply for the Making Homes Affordable program, it will require them to report to credit bureaus the mortgage reduction as a charge off. I have worked 25 years to keep my good credit standing. Not once have I ever "bounced" a check, or been late with a mortgage or credit card payment with Bank of America. Not once. How dare they haphazardly, place my data on someone else's property, not follow up with me, and ruin my good credit which has earned me preferred interest rates, etc., and that I've worked hard to maintain all my adult life.
I need a lawyer to take on a class action suit. It's being done in Cincinnati and needs to be done in North Carolina. Please Help! Additionally, I noticed that although my principal has been reduced annually, and I'm on a fixed rate, the mortgage interest total increase in 2009 over 2008. According to the first two months of 2010, if something isn't resolved, the annual interest paid will be higher than 2008 or 2009 even though the principal amount has been decreased.

November 11, 2009, I began the refinance process for a ten year loan at 4.25% with BoA. The originator, Jesse **, was quite helpful and I was guaranteed a phenomenal deal due to my credit score of 800+. I was also assured of a negative 0.5% points at closing that would equal $307.50 paid to me at closing. The following week, I received the package via US mail that requested pertinent info such as W2s, pay stubs, employer verification, etc. I returned the package within 3 days and did not hear from the loan processor Sylvia **. I finally got lucky and was told by Ms. ** that the process was moving, however, she was very busy with the burdens President Obama had placed on her with refinancing operation. I was assured that my loan would close before the end of 2009.
Ms. ** failed to contact me and 2009 gave way to 2010. I contacted Sylvia **'s boss, Kevin **, who assured me he would look into the matter within 24 hours and respond. Two days passed with no response. I spoke with Jesse ** (originator) and was assured he would check into the matter. Two days after that, I received an email from Mr. ** who apologized for the poor performance of processor Sylvia ** and promised that I would receive a $500 lender credit (whatever that is) at closing. I next heard from Ms. ** that since the "Seasoning Period" had lapsed, I would have to resubmit W2s, pay stubs, proof of employment, etc. I complied and was scheduled to close the loan on Feb. 20, 2010 at my home. I reiterated that at closing, if the documentation was not correct and did not include the points, lender credit, written appraisal copy for me to keep that I paid $425 to receive, I would not negotiate any further.
A notary public appeared at my home as promised on Feb. 20 at 10:00AM. He stated he could not discuss the loan, only witness the signature on the paper provided by BoA. I did not see the negative points, the lender credit or the appraisal. I did see that BoA assessed in a fee of $8,259.60 for hazard insurance. He repeatedly told me that the "Notice of Right to Cancel" was my best choice to resolve the problem. As this occurred on Saturday, I will be faxing and mailing this document to BoA on Monday, Feb. 22, 2010. I intend to recover all monies invested in this futile effort.

I had a mortgage with Countrywide and it was bought out by Bank of America. From April 2009 to October 2009, I made phone calls and sent letters weekly to be approved for a loan modification because of income change. I received the loan modification in November 2009. I was told my payments would start February 2010. I have sent a total of $2000 which is enough to pay through April 2010. I received a phone call from a home retention team telling me my payments were received but I'm still past due. This is the last straw, if they don't honor their contract and the info Caina ** relayed to me. I want to sue Bank Of America. If they don't update my payments correctly, I will be behind in my mortgage and lose my home.

In June of 2009, I first sent in the requested documents to Bank of America. I requested to enroll in the making Home Affordable Program in order to secure a reduction in my mortgage. I was told to send in the necessary documentation which were pay stubs, banks statements and a letter of financial hardship of which I did so 5 or 6 times already.
I then resent all the requested information to them again on 11/17/09 and spoke to a supervisor who informed me that everything was received and that from the review of them I had met the qualifications that the plan merited. I was first told that the process could take up to 45 days which it did not. Then after following up to question why didn't I get into the plan yet, I was told that my information was reviewed and the process had begun but it could take more time due to the high volume of people they were servicing who had the same request. They then said it would take between 60 to 90 days.
However in the interim, I was calling them to check on the status and was told everything was going well and that they still had my information and that I would be hearing from them within the 90 day time frame. I informed Bank of America I could not afford to keep making the mortgage payments with the high interest rates I had paid in the past before my wife and daughter passed away and that I needed to be in the plan asap.
On 2/19/10, I received a letter from Bank of America stating the due to it being past 90 day that I needed to resubmit all my information again to be considered to enroll in the making Home Affordable Plan. I called Bank of America and was told I had to resend everything again and that I would have to start all over again which could take up to 90 days or longer because the documents the needed had expired.
I told them I was told on several occasions by their representatives that my information had been received and were being reviewed so why would I have to start the process all over again. I told them I could not afford to continue paying the high rates that I had been in the past. I believe that they do not want to really help and they are trying to frustrate me to give up so that they can continue to get the highest amount of money from me as possible. I cannot afford to pay the high mortgage they are charging me and it will eventually lead me to go into foreclosure.

I was with Countrywide Mortgage originally, refinance in 2007 and got a subprime loan, not knowing at the time. My interest rate was supposed to be 8%, by the time I got to closing, it was at 10.125. I had to wait 2 years before I could do anything about it. I was trying to run a business which was unsuccessful at the time. My credit rating was not good.
So I called Countrywide and told them that I was not making a large income and I was running one month behind on my mortgage. They referred me to the Home Retention Program. At that time, my mortgage was $985.00. On that program, they increased my mortgage payment to $1,275.77 and told me I had to pay it for 7 months without being late. I did it.
Now, I got my credit score up paid all my bills and I have been on time with my mortgage payments with 1 late in a year. That’s what Bank of America told me I needed to do in order to refinance my loan for a lower interest rate. I spoke to a loan officer Christine Y. and she told me also that’s what I need. They processed the paperwork and I sent in the needed documents that they asked for.
A week later, the underwriter called and said that she denied me because of my credit report for the year 2008 on my mortgage which was late too many times. I explained to her that I was on a repayment plan through her and they reported me late every month until the program was finished. She said that if I gave her proof, she would reconsider. I gave her proof with a letter showing that I satisfied the requirements. She need a repayment agreement terms, I said that they only sent statements every month and I paid. She said that was not good enough. So I called Bank of America Home Retention Department to get a copy. They said that they could not reproduce these documents even though it was in the system. They referred me to Customer service. Customer service said that they had no way of faxing or emailing and even if they could, they could not do it because of customer protection.
I called the loan officer and asked her to call them to confirm I was on the program and the agreement. She didn't. I emailed the underwriter explaining all of this to her and she said even if it was confirmed verbally she could not accept it. All of this is with the same bank. All of them seem to operate on a different system and no one helps the order.
Needless to say, I am still stuck with the 10.125 interest rate, which is on an Arm payment. The loan officer said that it was not her job to help with this and the underwriter was very rude and not a very nice person. I have emails copies of all of the conversations.

My husband refinanced our condo in Warrensville Heights, OH for $50,000. The loan was almost immediately sold to Countrywide. We had some problems and were trying to work them out with Countrywide when BOA bought Countrywide. Then things really got bad. They would tell us one thing then after we sent the money, they said they would accept. They continued to foreclose. After the news about subprime loans was made public and the stimulus was announced, they said they would work with us. They claimed to modify the loan to help us but the monthly mortgage went up from $456 to $517.
We started paying that and a couple of months later, we were told that we had to pay $617 per month. We've asked them how they think we could possibly pay almost $200 per month more when we were struggling with $456 per month. All they can say is that there is nothing they can do. Currently, we are a month behind and the late fees are building up. This company is pretending to work under a stimulus plan. I really want to refinance with someone else but they have made our credit so bad that I don't think we can. Please go forward with a class action against this company. They really need to pay for what they have put people through.

They sold us a mortgage loan we could not afford. Now we have been trying to get a loan mod from Bank of America for over one year! We keep getting mods doing what we are told, then it not being accepted. Our credit rating is now in the toilet because of this. I'm disabled and very stressed out because of this.

In July 2009, I was mailed a letter from BOA stating that my account was three months delinquent. After several attempts to contact them, I finally got through to a rep. I wasn't notified of the take over of Countrywide nor was I sent any monthly statements or bills. After being told that no payments had been made since BOA took over, I told the rep that these payments had been made by using their automated services.
During this time that the payments were being made, I became suspicious because there was no payment confirmation statements mailed like Countrywide used to. So in august, I started mailing money orders to pay my mortgage. October 2009, I received another letter form BOA, stating that they still hadn't received any payments. After contacting them and being transferred from one department to another, I argued with several different reps to finally be told that the payments had been found and not to worry.
In January 2010, I received a letter from BOA saying that my house was in foreclosure and a hearing had been scheduled. The sale date was set for March. They said I had not made a payment in 11 months. I asked for a payment summary for 2009 to be mailed and was given the runaround. After calling several times and being hung up on, I finally talked to a rep and stayed on the phone for over an hour going over my money order payments. The rep did some digging and said that my payments had been received and used for attorney fees for foreclosure. I contacted several attorneys and was told my only options were bankruptcy or to pay the amount BOA was asking to stop foreclosure. I attempted to get the exact amount needed for three weeks from BOA and their attorneys. I was given one amount $10,300 and a couple of weeks later mailed another $13,100.

My nightmare has been going on for 5 years now. My mortgage was with Countrywide. My first loan modification was sent to me in August of 2007. I signed in front of a notary and sent it back. The next day, I received a letter notifying me it was denied. This already happen a total of 3 times. I was making my payments but six months after the last modification, I was denied and I received a notice of foreclosure. I called Countrywide and they said I hadn't made a mortgage payment for 6 months. I sent them proof of payment.
Then Bank of America came into the picture and this time, I signed and returned 2 loan modifications which were also denied after the fact. The reasons given were: documents not sent in, investors wouldn't approve it, tax lien, not qualified, no proof of home insurance, just to name a few. The one used most was documents not sent in. I have kept all letters, proof of faxing of documents (sent them 20 times in one day, record) all of the denied modification agreements. I have kept accurate records of who I spoke to, when and the time of day. I have an ARM and the payments are now too much for me to make.
I became ill in 2005 and was forced to resign from my employment. I thought that this would qualify for a hardship modification but I was mistaken. I understand that BOA isn't required to give a loan modification, but why can't they be up front about it. They raise your hopes and you do what they ask of you then they give you the red tape run around. It boggles my mind that when they needed help, they got it from our tax dollars and now that we need help, they turn their backs on us. There needs to be a class action suit and I would very much like to be part of it.

Every time we call them about our home modification papers to lower our mortgage, they all have a different story. We are so confused. One said it went through, the other said they never received our papers. We wrote a letter explaining our situation, and we sent in verification of our income and they still are giving us the runaround and we are sick of it this has gone on for a year now. We want some answers now! Have they lost our papers and where are they? It seems as if no one in that department can answer any of our questions, what is going on? We are good people and deserve some answers about our home modification program!

On February 18, 2010, after receiving an escrow account statement in the mail, I sought to inquire as to the accounting. I was notified that my taxes had been increased and because of that, the account would have a shortfall and I would thereby be required to incur a "federal law allowable reserve requirement" of a monthly expense of $29.72. I asked to have that removed and it was granted.
Subsequently, I inquired as to if I could lower the amount of my monthly payments by paying a portion of the escrow account in advance I was thereby told that I could not do that because they took the total amount due 2 X $866.65 taxes + $415.00 insurance and divided it by 12 to come up with the monthly amount due $179.03. I first spoke with Talisha ext. 4327 and then I asked to speak with her supervisor and was given the same information by Lynn ext. 6713. My inquiry was that I wanted to change the monthly amount to $775.00 versus the $814.07.
My argument was that I was able to do this in past years by paying a lump sum to the escrow account thereby bringing the payment down to the $775.00. I asked if the policy had changed and was told that it has always been this way. After making other inquiries, I realized that these two individuals had "dug in their heels" and were both agitated that I asked for an adjustment such as described above. In conclusion, my reasoning was that if an account can be increased then why it cannot be decreased by applying a prepayment to an escrow account. Lynn at ext. 6713 stated that if "I paid $10 thousand dollars to my escrow account, they still could not change the monthly amount of $179.03." I was basically forced to close the escrow account and make payments personally.

In November 2009, Bank of America bought the mortgages which were held by Countrywide. Bank of America never notified us of this change, did not send us a coupon book or a statement notifying us to make the payment to a new address with them instead of to Countrywide. We made our December 2009 mortgage payment on December 3rd, and sent it via Huntington Bill Pay to Countrywide as we have been doing for years. According to Huntington's Bill Pay Department, they found out that the payment should have been automatically forwarded to Bank of America from Countrywide, but there was a problem with the transfer file when Countrywide sent the payment file to Bank of America.
Bank of America claims to have never received the payment and cannot locate it anywhere within their files. I have called Bank of America at least a dozen times on my own and each time the customer service rep acts like I am lying and did not make the December 2009 payment. I have been working with Huntington's Bill Pay Department and they have sent the file transcript which contains the trace number for my payment to the Bank of America Payment Research Department. It took about six times of Huntington sending the transfer file documenting my payment to them before they even acknowledged they had received the documentation.
Bank of America still claims they cannot find my payment, even though they have Huntington Bank proving to them that I made the payment. Huntington sent Bank of America the Trace Number, File Transcript, everything they need to locate the payment I made. I have had several conference calls with Bank of America and Huntington together where Huntington has gone over and over the fact with them that I made the payment, and that they have sent all of the documentation.
Bank of America says they have received the documentation from Huntington on my proof of payment from Bill Pay, but now they won't accept it because Bank of America says it's not enough documentation. What else do they need to prove I made the payment? According to Huntington, I am not the only person that this has happened to when Bank of America took over Countrywide's mortgages. Huntington informed me that this has happened to thousands of customers and they are having the same problem getting this resolved as well. This has been going on now for three months and we are no closer to a resolution from the first day when my payment was lost in the file transfer from Countrywide to Bank of America.

In October, we (my fiance and I) inquired about the Modification Plan in which BoA sent out letters on. We spoke to a rep for the modification and she asked us a few questions. She stated that within 45 days, we would receive a package in detail as to what the modification plan, if we were approved, would cover. We never received a package. In January, we got a statement from BoA stating that our taxes has been paid and that we owe them taxes for 2009, that they are building an escrow which doubled our mortgage from $778.00 to $1559.03. We called and BOA modification department stated they saw that the file was incomplete and that they would investigate the matter and contact me within 72 hours. We were never contacted.
Also, as I went to pay on my mortgage for Fed, I called the Bank and took $1559.03 from the account without my approval due to us being on a pay plan which was cancelled in January due to the conflicting balance. I have tried to reach the modification department, but to no avail. I requested the money to be returned and nothing.

I asked for a home modification loan or alternative financing in April, 2009. I sent all requested information. I cannot get anyone to acknowledge my call or call me back. They did call once, but after 60 seconds, the call disconnected and I could not get anyone else on the phone. I am still waiting for them to follow through. I am suffering economically because of their inability to follow through.

I applied for a Loan Modification in July of 2009. I was told that I was not qualified for the "Obama Plan" and that I would be referred for regular modification. I was approved the beginning of September 2009, told via the account status link that I would be hearing from a negotiator soon and that I should not call back till after October 22, 2009 or I would increase the amount of time it would take to process my modification. I called at the end of October. Three separate people told me they found no record of the modification. I was finally connected to the Modification Department and they advised, "No worries, I was approved." Despite this, off and on, I received notices of acceleration of my loan. I would be called soon by a negotiator if I didn't hear something by December; I should call back. I called in December for the same song and dance. In mid December, on a Sunday, I go out onto my porch and there is a man standing there. He is there, sent by my lender, to see if I still live there.
So by January 1, there is still no negotiator, I call back. All this time, I'm not even being given a payment amount for what I should pay. I am sending payments, some are being applied, some are not. None are returned though. I call mid January and the same story: "just behind on paperwork, keep sending money, I'll hear something soon." I log into my account at least weekly to check the status. So in late January, I log on and there is no information on "workout".
I call Bank of America. I am advised I never applied for a modification. After two or three more people, I finally get someone who says that I have, that I have been referred from Mortgage Modification to the Obama Plan to see if I would qualify under that plan. I point out that I already had been denied by them and referred for a regular modification. So anyway, I have to wait for them to evaluate me for Obama plan again but "I'm definitely approved, don't panic." I told him at this point I've been approved for almost six months and still have no paperwork. I have no payment amount, no indication of this on my loan at all for anyone to see.
The page is up and down. One day I'll log in and it says my file is under review, don't call before March 8th. If I do it will slow down my decision? What decision? I was supposedly approved already six months ago?! The next day, it will say there is no workout information at all.
I also asked about the payments. I've emailed about a dozen times. They either send back an email saying they appreciate my email but could service me better by talking to me in person or they send back and email telling me when my last payment was and saying they can't discuss future payments at this time. I am asking what they did with the past checks I sent that they cashed, but did not apply to my account.

I was with Country Wide that was bought out by Bank of America and I was not aware of this until I received my mortgage statement from Bank of America. In January 2009, I requested a loan modification due to a series of circumstances that was affecting my finances. I submitted the paperwork that was requested and I continued to call BOA to inquire about my modification and was told it was under review.
I continued to call on the status; however, I called BOA approx. on 1-28-09 and was told my modification was denied due to missing paperwork. I asked why was I not notified ,the representative stated that she did not know and I asked how can they review something and have missing documents. Why was I not told at that time. The representative stated she did not know.
I also have a concern because my insurance lapsed and I had to show proof that I purchased insurance. BOA has charged a ridiculous amount for them covering me. I asked if the amount was pro-rated because that amount is ridiculous if I actually have my own insurance. I also requested to receive a copy of the policy that they have for the coverage that they are making me pay on five different occasions and have not received it as of yet. I then received a letter stating that foreclosure is being put in place because my bill is now over $7000 and I was also told that I need to submit another modification form. I received a letter for foreclosure and I have not received a copy of the homeowner's insurance policy and there are sink hole claims that are being processed in my subdivision.

I got behind in my mortgage payments. You may have heard that there is a rash of foreclosures lately. I was one of these sad cases. Because of a good year end bonus, I was able to rectify the situation. On Feb. 3, I requested reinstatement figures from Bank of America. They said 3-5 business days. I thanked them and waited.
3 days passed--no figures. 5 days passed--no figures. I called and was told by another person that it was often up to seven business days. I told this person that I worried I would not get the figures in time for them to be valid (there are strict dates for which the figures are good for). She told me, "There's no chance of that happening." Two more days--no figures. I made another call. They offered to put the request for figures in again. I asked if they would be the same figures I already requested. Her response: "I don't know.” Two more days, still no figures. When I called for the fourth time a chipper woman told me not to worry, "The figures are good until February 26th.”
I received the figures today, February 16. Along with the cheerful information that the last date the figures were good for was February 17th. I received the figures literally less than 24 hours before they would be worthless. I tried seven--repeat seven--times to get a hold of someone at Bank of America. After literally 38 minutes on hold of my seventh attempt a curt woman told me, "All you can do is send them overnight mail and hope it gets here in time.” I didn't verbally abuse this person (who truly deserved it). Instead, I rushed to the bank and rushed to the post office and did my best to send a certified check from Wisconsin to Texas. My fear is the post office will be a day late and that, somehow, Bank of America will say it's my fault.

We received a foreclosure notice and have spent hours on hold with no results. Evidently 3 payments in 2009 were returned NSF but we were never notified. The Jan and Feb 2010 payments were rejected by BOA. The attorney handling the foreclosure told us we need to deal with BOA but I cannot find any way to contact them other than the 800 number. We don't have the time to spend waiting on hold. I would like to contact them by mail or email but can't find any information on how to do this. Our property is going to auction in 10 days and we don't know how to stop it.

Bank of America loan. We are to sign a modification loan with BOC by February 26. Previous lender being Countrywide. Allied Mortgage in Greenville, SC, a broker for Countrywide, called us one night after getting information that we were in need of a loan. At that time we thought it was an act from God because our plans of building our dream home, and paying for it as we built, was stopped abruptly when a heart disease forced my husband to retire early from Michelin on permanent disability. A mortgage would allow us to finish our home and get out of the camper we had lived in on our property for over 2 years. The broker refused to reveal his source of information.
We only needed $100,000 to finish our home and were able to handle payments on a loan for that amount easily. After weeks of total chaos we were offered a mortgage that included a long list of debts that had to be paid off to companies we never knew we owed. We were told that these companies had bought out other companies that’s why we did not recognize them and that after paying on time for a few months, our credit score would rise and we could refinance at a lower interest. We were also told that time was of the essence because my husband’s health would prevent us from acquiring any mortgage if we didn't "lock in" now.
We had to borrow over $200,000. We believed this to be our only hope. It wasn't long before we realized that we had been conned into paying other people's debt as we became aware that the broker and the whole staff were gone and nowhere to be found. We later heard that they were all in prison for mortgage fraud. Now we have been offered a modification loan from BOC with higher payments after having done a 3-month payment plan, etc. How long can this continue? We have been living this nightmare for years. My husband's condition now requires me to be with him almost constantly resulting in my income dropping dramatically. We have a lot of equity in our home but are continuing to be manipulated because of our situation. We are barely making ends meet. How do we find out if all these debts paid off by our mortgage was legitimate?

This is done every two weeks as before, but I noticed that now a portion of this amount is now placed in escrow instead of the principal and interest.
I have called and talked to several representatives that finally believed I have made payments when I go directly to my bank to have the assistant manager speak to them about seeing the payments made or I repeatedly tell them myself which dates the payments are made but have to speak to many people and wait sometimes 20 minutes on hold to talk to the next person. Each person at the loan center stated that there has been no record of my contacts or conversations. No amount of promises that the situation will be corrected has been fulfilled.
My credit will begin to reflect this problem. I had been paying for years with Countrywide and cannot understand why this bank cannot see that payments have been made. I cannot afford to pay my mortgage all at once, as in once a month. I am afraid my home will be in line for foreclosure due to either new bank policies or business neglect. My only phone is a Verizon cell and the phone calls caused my minutes to go over the plan resulting in large cellphone fees. Nonetheless, the communication is lacking and I am running into a brick wall.

My husband lost income and cut on overtime and pay hourly. I had to stay home taking care of my oldest son that has special needs and we have adopted our nephew. He only have us to count on. We have submitted an application for the home affordable housing program, the President Obama program, to help us and Bank of America have denied us twice first because we don't have enough income and now that we received $353.00 a month more income and extra $50.00 for food. We don't qualify? My husband and I are very worry and distress. We were hopeful to came to an agreement with our lender to give us an affordable payment instead Bank of America has keep on going with the foreclosure proceedings and the sale date of March 17th 2010. Please help us. Don't leave my children without a home. I will be very anxious to hear from you.

I purchased a Bank of America Total Protect Home Warranty because the offer came from my bank. I quickly realized that either BOA is not aware of what a fraudulent operation this is or they are part of the fraud. Fortunately, I purchased the policy in November 2009 and have not paid a lot of premiums. I have made 2 claims, one on 12/29/2009 for a washing machine and one on 1/6/2010 for a dishwasher. The following is a detailed account of what happened. I called in the problem to Bank of America Total Protect about my 7-year-old Maytag washing machine that it would not spin. They said a repairman would call, and they did that day. The repair company, Stark Appliances, did come out the next day. I paid them $75 for the deductible and they told me after evaluating the washer that the repair cost would probably exceed the value of the machine. The next day, Total Protect did call and they told me the machine would be replaced or I could receive $275 in lieu of replacement. I chose to have them give me a new machine. Although it took many phone calls, after 2.5 weeks, they came on a Saturday to replace the machine. The problem is they are supposed to replace the appliance with comparable features, they did not. I was given a machine that did not have the same selection of wash cycles, did not have a second rinse cycle, did not allow for automatic dispensing of softener, and it did not have an automatic temperature control for the wash water. The fact it was a Hotpoint and not a Maytag did not bother me, but it was not a machine with comparable features. When I complained, they said it was an equal machine and I would have to accept that.
On 1/6/2010, my dishwasher broke and I called it in and like the washing machine, Stark came out and said the machine could not be repaired. Total Protect said they would replace it. You might say why did I agree after the washing machine incident, but I had not received the washer as of that date. The dishwasher came and was installed, and after I began to evaluate the features, I found it did not have an elapsed time clock, a short wash cycle, and also did not have an automatic water temperature feature. I called and spoke to a supervisor, Josh, and told him to remove the machine because it was not equal to the machine I had. He said why did I allow them to install it and I said I did not know it wasn't equal until they left. After weeks of back and forth, Josh said he would remove it and pay me 2/3 of the value. I am a handicapped person and could no longer wait to use this. Josh said he would send me my deductible to compensate for all the problems I had.
I cannot believe that BOA is involved with a fraudulent operation and if you think I am blowing this out of proportion, Google "Bank of America Total Protect" and see all of the complaints. I will no longer trust anything this bank has to offer. I have sent a letter to BOA about this and will make a formal complaint to the NJ Consumer Protection Agency. I do not think it is right for a bank to make offers that are not truthful. The contract clearly states that replacements must be equal or better not just anything they decide to send.

My father passed away in February of 2008. He left a hefty mortgage on his home which we were unable to pay. I was advised to see if the Mortgage Company could sell it in a short sale. A couple of years before his death, he refinanced and it was appraised at $240,000. They had to do a drive by because it was a dump. After he passed, I had it appraised and it was between $130,000 and $140,000, which was really for the lake front only, not his home. I listed it for the mortgage company. The first offer that came in was for $100,000, but they countered at $115,000 and the people walked. The second offer came in at $115,000 and they countered at $125,000, they also walked. Then a few months later, Bank of America listed it for $47,000 and sold it for $48,000. Are we helping the banks? From what I understand, this happens all the time. Is this a scam?

My wife and I modified our mortgage in July with new September 2009 payment. Subsequently, all payments have been on time (including interest). In January 2010, we got our first 1098 interest form. However, less than two weeks later, we got a corrected 1098 that doesn't include the interest paid for the September through December 2009 loan payments. I called Bank of America and the customer service representatives told me that because our loan was not finalized until January 2010, that the 2009 interest payments would not be reflected. The net result is that I will end up having to pay federal taxes. By not including the actual interest paid for those four months (almost $6,000.00) towards my taxes will force my wife and I to have to pay federal taxes as opposed to breaking even for the year.

I had a problem with Countryside Bank loans where they only paid half of my property taxes for the tax year 2008 by the deadline of 2008. Not wanting a repeat of this in 2009, I contacted Bank of America who purchased Countryside on December 18th 2009 by phone and by fax. The tax bill was sent and they acknowledged repeating it on time. They assured me that the tax bill would be paid on time before December 31st 2009.
On January 10th 2010, I was notified that the taxes had been paid on January 8th 2010. I contacted Mr. ** and he said that it was nothing personal, noting that it happened to 6,000 other families in Wisconsin! That certainly did not make me feel better. To make it up to me, they have sent me a check for $83.40 which does not even begin to make up for my loss. I have not cashed it. I have written them to inform them that this is an insult and I would like more compensation. Not only could I only claim half of my property taxes last year and this year, 2009 taxes, I am not going to be able to claim my total taxes of $3363.03 and it will greatly affect my tax refund.
I am tired that this type of thing has happened two years in a row. They made a killing by sitting on top of so many people's escrow and collecting the extra interest.

I called and explained we were having difficulty making our mortgage payment on 12-15-2009. I spoke with Louie who took all my financial information and told me he had an offer for a new mortgage trial payment of $967.20 for three months and if we could make that payment for three months, our loan would be modified to a new affordable payment. After making the three payments, I called to find out what the status of the modification was and the rep told me there was no record of an offer or loan modification and there was nothing they could do. They acknowledged the financial info had been taken on 12-15-09 but for whatever reason, nothing was on their system for a trial offer. The only thing they could do was to have me reapply. I talked with a supervisor who was not helpful and said her system could not qualify us and she would have to call me back if anything changed. The new payment we were making has left us behind on our current mortgage even further with foreclosure guaranteed.

On January 5, 2010, I received notice of a payment increase in the amount of $1531.57 for an escrow account that had been created as part of my mortgage payment. The following day, I received a new coupon book for the increased payment, due on Feb 1, 2010. My monthly mortgage payments changed from $2,509.48 to $4,041.04.
I called BOA and spoke with a manager by the name of Jacquelyn at ext 5485 in Plano, TX who informed me that I had been placed on the Making Home Affordable program. I asked Jacquelyn who and when did BOA speak to regarding their intent to place me on the MHA program and who authorized this change to my account? The manager soon realized that BOA made a mistake and informed me that this program should have never been on my account. I have never talked with BOA nor made any request to be included in the MHA program. BOA changed the terms of my mortgage agreement without proper notification and acceptance from me or my husband.
Jacquelyn then informed me that BOA had paid $8,170.78 for my property taxes on 12/14/2009. This included a payment of $2,257.47 to the City of Desoto and $5,913.33 to the County of Dallas. I was informed that this amount must be paid back by 1/31/2010. No conversation was ever held between BOA and me to discuss being placed on a MHA program. By accepting these terms, I would be placing my family in jeopardy of losing our home, as I cannot afford to pay a $4,041 mortgage payment.
Also, after reviewing my account, I realized several other discrepancies that appear to be unfair and deceptive acts by BOA. My mortgage is not considered late until after the 16th of each month. I have always paid it on or before the 15th of each month, with the exception of this past December. I have never been in my home for five years and never charged a late fee up until this point. All payments are always paid directly to a branch office.
On 11/14/2009, my mortgage payment was walked into a BOA branch and according to my statement, was posted on 11/17/09. BOA charged $125.47 as late fees and added it to the balance of my account. My December payment was made on 12/31/09 at a BOA branch and posted on 1/4/2010 and payment made on 1/15/10 at a BOA branch posted on 1/19/2010 with another $125.94 late fee. After reviewing all three payment slips, I noticed that BOA used incorrect dates in which the payment was made.
I am writing this letter because BOA has repeatedly demonstrated unfair and deceptive servicing practices, which is causing financial hardship and stress for me and my family. I now see how a family can easily lose their home that they have worked so hard to have when financial institutions like BOA commit this type of unethical behavior. Being in the banking industry, I realize that multiple laws have been compromised by changing the terms of my agreement without authorization and intentionally changing my payment dates to retrieve unwarranted late fees.BOA should absorb the cost of my taxes, since they paid them without authorization. They should remove all late fees from my account and retract any negative reporting to any and all credit bureau services.

I was advised by the BBB to contact you with regards to our home situation. We originally purchased our home with an ARM in 2005. We have been trying to get out of our ARM since 2006 with no help whatsoever. Bank of America currently holds our mortgage and while we understand they are busy, all we are asking is that we re-finance into an affordable fixed rate mortgage. I have been in my job for 4+ years, my husband is freelance but brings home a steady paycheck. B of A will do nothing to work with us even after the BBB opened up communication with them for us. I also have an e-mail from a B of A employee that states he was instructed not get into "this type of matter". We want to stay in our home, we want to pay our mortgage, and we want a fixed rate. Is there any way you can help us? I am more than happy to give more information if needed. I have documents dating back for over a year now. Thank you.

I recently refinanced and started the process in March of 2009. For my log home, I had an independent appraiser do an appraisal on my home. I submitted these documents to Countrywide, John ****, ****. After many months of waiting to close and as CW transitioned to Bank of America, BOA required a new appraisal. I refused to let the appraisal company do the appraisal since I had already had one done. But John finally contacted me and said that I would not have to pay for the new appraisal and that BOA would cover it.
At closing, in August 2009, the appraisal charge appeared on closing documents. I crossed these mistakes out and initialed the changes. But the loan was still improperly processed. It has been very difficult to get in touch with either John or my loan processor Joseph **** in which I have left many messages but no responses. To correct this issue, I would simply like an account manager to credit my account, the $425.00 for loan number ****.

I qualify for government programs to help me avoid foreclosure but my lender has not been willing to work with me. I am current on my mortgage but it seems that they want to miss payments before they will help me. In some cases, their reps are even rude. I am underwater and would like to be treated fairly so I can avoid the inevitable. The houses beside me are in foreclosure and the property is unkempt, which lowers the valve of my home even more. My mother passed away recently, putting a financial burden on me.

I have been trying to get my mortgage straight with BOA for months. They cancelled my PayPal/26 in December without my permission. I called them and signed up for it again which was supposed to be in effect starting 2-12. I received a letter today from BOA stating my PayPal/26 has been cancelled again. Every single one of my mortgage payments has been made on time since December 2008. I never had any issue for years with my mortgage when Countrywide had it. My headaches began when BOA bought it.
Dealing with BOA's reps has been horrible, rude, nasty, disrespectful and they refused to transfer to a supervisor. I called today and was on hold 20 minutes and was supposed to speak with a specific rep. I left him a voicemail and I would be more than willing to bet he will not call me back. I can not afford to re-fi or I would just to get away from BOA. They are now claiming I have been a month behind on my mortgage for a year? A year, yet they never said anything about it? They are wrong. Yet despite all my letters, calls I am getting nowhere. This letter today is the final straw for me.
I have spent numerous hours online getting all my mortgage payment info so be sure I never missed a payment. I have written several consumer complaint offices as well as copying all my complaints to BOA. I am being accused of being delinquent on something I'm not and for the second time BOA cancelled my PayPal/26 without my permission or my knowledge.

After BAC took over my mortgage loan from another company, my account became unmanageable. They were telling me I wasn't sending in my payments even though I had the canceled checks. They applied my last payment to the other mortgage company to my new account with them even though the other company had already cashed it. In other words, they sent me the canceled check the other company cashed and wanted me to replace it. That would mean that I would be making a payment to both companies for the same month. That is not even legal.
This mess has been escalating and now they are saying I am in default and owe three months even though I sent my payment, usually certified which cost me and get the cancelled checks. I have sent copies of the checks but they don't seem to get my mail unless it is certified. I could go on but it would take up too much time. I am worried about my credit, my escrow and insurance for next year if this is not resolved. I have called many times only to talk to yet another person who seems not to know what is going on. They tell me to ignore any default and late charge notices. Right. What a nightmare company! This has been going on for seven months.

The purpose of this complaint is to present a formal document outlining Bank of America's cavalier disregard for the consumer in the execution of their policies and procedures relative to loan servicing, payments and collections. In the last fiscal quarter 2009, Bank of America (BOA) took over Countrywide Mortgage Company. I was a longtime customer of Countrywide with two mortgage loans on two rental properties. Both loan balances are low with good equity value. There is little money for BOA to recover on either of these mortgages.
On November 17, 2009, I received a telephone call from a call center in India. The caller identified himself as a representative for Bank of America and asked for the last four digits of my Social Security number. I asked why he was calling. I had no business with Bank of America. He said it was regarding a delinquent mortgage payment for a property that I own. He stated an address, but quoted an unfamiliar payment amount. He said he could give me no further information until I gave him the last four digits of my Social. I told the collector that if Bank of America had an unpaid debt owed by me, they needed to contact me by U.S. mail outlining the obligation. Believing I had no mortgages with BOA, I thought it was a scam and hung up.
I did, however, check my bank account to confirm that all electronic payments for the month had been processed in a timely manner. They had been. I was still uneasy. How did this stranger know that I owned property at the address he had given me? Since I manage most of my accounts online and fearing my personal information had been compromised, I logged in to the mortgage company site (Countrywide) and was redirected to Bank of America's site. The nightmare had begun.
I discovered that Bank of America had purchased Countrywide, the lender for two mortgages that I have had since the early 1990s. I had received no notification of this transaction either online or through U.S. mail. After a couple hours research on November 17, 2009, I finally talked to a customer service representative with Bank of America. I then learned that Bank of America had changed the account numbers for both loans (again, without my knowledge). Neither loan had posted the November payment. I said that I would have a representative from my bank, Huntington Bank, get in touch with Bank of America and straighten the matter out.
I contacted Zack (CSR) at Huntington Bank the same day, November 17, giving him all contact information from Bank of America. He said he would take care of it. The payment had been sent as directed (and was deducted from my account balance) on November 5, 2009. I assumed the problem was resolved. Bank of America's collections department began calling me daily. The personnel were rude, hard to understand and unwilling or unable to be of assistance. They pursued a bullying style designed to intimidate.
On November 19, 2009, Huntington Bank confirmed by U.S. mail that the bank had been in contact with BOA to correct the matter. Since I was still receiving collection calls, I called Huntington Bank and was told that they had spoken with Lea (BOA) and complied with her request to send transmittal information.
On November 23, 2009, I spoke with CSR Allene (BOA). She told me to fax copies of the correspondence from Huntington Bank to the Correspondence Dept. (BOA). I attempted to do so, but the number was not in service. She said she would note the file and stop the collection calls. She pushed refinance even though I had not asked. I had in fact made the remark that I had never had a problem with these mortgages until BOA became involved. The collection calls did not stop.
By December 3, 2009, I decided that BOA had sufficient time to rectify their mistake. I had received no information through the mail regarding the change of ownership for the mortgages (and new account numbers), the alleged late payment or notice of resolution. During this same period, I had received numerous direct mailings from BOA relative to credit and refinance offerings. I was still receiving calls from out-of-country collectors.
I called BOA and spoke with CSR Shana who took my information and offered to connect me with the refinance unit. When I said no, she reluctantly told me to call the Research Team. I did and spoke with Shawntel. Neither CSR was attentive and both took the attitude that I was in fact late with the payment and should talk with their refinance department to work out a payment arrangement. Shawntel did give me the fax number for the Payment Research Department (BOA).
I sent copies of the letters from Huntington dated November 19, 2009. She also asked that I send a copy of my bank statement confirming the payments had been deducted from my account. I did as requested. In addition, I tried again to send copies to the Correspondence Dept. (BOA). This time, the attempt was successful. These faxes were sent on December 3, 2009. On the cover sheet, I asked to be notified in writing that the account had been corrected and the problem resolved. That request was ignored. I heard nothing from Bank of America. I continued to receive direct mailings from BOA offering to refinance these properties.
On January 12, 2010, after receiving yet another collection call and being notified of a negative change in my Experian credit report, I called the number I had for the research team and talked with Nancy (BOA). She was the first person to take the situation seriously, was polite and attentive. She said her files indicated the situation had been resolved and the payment posted on December 18, effective date November 5, 2009. She said the credit bureaus would be notified. I checked my credit report and disputed the negative BOA entry. I finally received a letter from BOA (dated January 13, 2010) that the credit report had been adjusted.
On Thursday, February 4, 2010, I received a call from an out-of-country call center. The caller identified himself as a representative for Bank of America and asked for the last four digits my Social Security number. I asked the purpose of the call and he refused (rudely) to speak with me until I divulged the Social Security information. I told him I conducted no incoming telephone business with BOA and hung up.
Again, on Monday, February 8, 2010, I received a call center collections call from BOA. I refused to give my Social Security information, but the caller did say she was calling about a late payment for February 2010 on one of the properties I own. Huntington Bank had sent the payment as authorized on February 5, 2010. The account number was corrected to the new number assigned by BOA.
The February 5 date is well within the grace period for the payment and is the date that the payment has been sent for many years. The collector was rude and abusive and I hung up on her. I called the number and extension I had for Nancy, heretofore the only civil person I had spoken with at BOA. I was connected with Tom in Home Loans. He told me the payment had not yet posted. I explained it had been sent electronically on Friday, February 5, 2010. The payment had been deducted from my account on that date.
He said he would "note the file" with a "promise to pay." He was very courteous; however, he made it obvious that he had no authority to do anything of substance to stop the situation from escalating again. He said he could stop the collectors for 30 days and offered to connect me to someone who could assist me with refinance. To his credit, Tom did listen to my concerns and did give me a fax number for Customer Correspondence to file a "formal complaint." This is the same number given me by Allene on November 23, 2009 to send copies of the Huntington Bank confirmation of transmittal of funds. It didn't work then and I have little hope it will work now.
I believe Bank of America is operating in an opportunistic fashion with little regard to customer service or accuracy of information. No discernible attempt has been made on their part to remedy their error(s), but rather to force conditions fueling refinance profit centers. The focus of every BOA loan-servicing representative I have talked with has been to make an offer to refinance the loans; thereby, incurring additional fees and increased interest income for Bank of America. Consumers are driven to the loan-servicing units by the intimidation tactics utilized by their collectors.
The phone call on February 8, 2010 was regarding a debt that not only was paid but also was still within the grace period for timely payment. I am frustrated and want to make this situation created by Bank of America's own cumbersome and questionable operational tactics go away. I did not ask to be a BOA customer and from where I now stand, I will go out of my way to do no further business with this unscrupulous and opportunistic corporate monster.
BOA continues their harassment with abusive, unfounded telephone calls that interrupt my work and home life. They have taken countless hours away from work in attempts to resolve this situation. I have been forced to spend extensive amounts of time monitoring credit reports, writing responses and otherwise dealing with this situation.

Bank of America took over my home mortgage from Countrywide last year. On September 3rd 2009, I called Bank of America inquiring on what information they would need for a loan modification as I was in an ARM. I did not believe that I would qualify, so I did not call back with the information. Bank of America as of September 2009 has since stopped applying my timely monthly payments to my mortgage loan, denies receiving payments, accumulated $223.32 to date in late charges, put negative items on our credit reports causing our other lines of credit to be cut or eliminated, increased all of our interest rates and now my credit rating which was great (735) on 10/15/09 is now low (616) on 01/15/10.
I also received my Form 1098 Mortgage Interest Statement and BAC failed to include the interest amounts (approx. $4000) that I paid, BAC received and refuses to apply which will now affect the taxes that I will owe. I have taken a great deal of time off of work including today and made numerous calls to BAC weekly since Sept. 3rd sitting on hold for over two hours at a time, wrote a letter and included documentation of all of my payments that they have received and deny receiving, sent an email and a fax.
I have written the White House, multiple State Senators, Federal Reserve, Comptroller of the Currency and filed a complaint with the United States Senate Committee on Banking, Housing and Urban Affairs. According to BAC our account is being handled by the Office of the President but each call takes over three hours of dealing with customer service, proving payments have cleared my bank and sitting on hold before I eventually get to the Office of the President.
On 12/7/09 BAC lawyer Patricia B. (1-800- Ext. xxxx) read off our resolution request to stop the loan modification process, apply our mortgage payments to our loan, withdraw the late charges and negative items to the credit agencies and stated that she would call me back with a resolution within a week. She did not call me and also has not returned two other voicemails I left her since 12/7/09.
I've had Independent Investigators with BAC come to my home twice and was told that it is a foreclosure procedure. I received a notice dated 12/14/09 stating that BAC is in the process of obtaining the documentation and information necessary to address my questions and concerns and that they will provide a more complete response within twenty (20) business days. That time has come and gone with no resolution or response. The last three-hour call to BAC I was told that over a thousand dollars of my mortgage payment was applied to something having to do with a loan modification and not my mortgage payment.
On 12/30/09, I was told by Evette G. (BAC Office of the President) that my account fell through the cracks when she realized that my account was not under a loan modification. I was then transferred to Tenisha D. (866-) who requested I send bank statements, tax returns, paystubs and a hardship letter for application of loan modification but then stated that if I was upside down on my loan that I wouldn't qualify. I told her that we are upside down due to the housing market so we would not qualify. After putting me on hold, she returned stating that we would qualify. I did not submit the documentation and do not trust or believe anything that I am told by BAC and believe that they are only going through this process to cover themselves and use my monthly mortgage payments for something other than what they were intended.
I would greatly appreciate any assistance that you can give me as this situation has not only destroyed us financially but also physically and emotionally. BAC has destroyed us financially by placing untrue negative items on our credit report causing other creditors to increase/cancel our lines of credit. As far as my physical health, I cannot stop shaking, can't sleep and sick to my stomach constantly.

We pay mortgage and we never had problems before with previous company within 10 years. It’s happened in January 2010. I checked my PNC Bank account and I saw that Bank of America did not take money for mortgage payment. I spoke with representative of Bank of America and gave her my debit card. She said payment will be posted on January 8. I have all copies about this withdrawal for my mortgage payment. I checked my PNC Bank account for next payment in February and Bank of America did not take the money again.
I spoke with Bank of America again February 2, and the representative told me, "We did not receive your January payment." After he checked records, he said, "Sorry, your payment was placed on an unknown account," and after our conversation, Bank of America charged my PNC account twice by mistake, and my account became negative. I spoke with a bank representative, Louise **, and he said, “It was our mistake, but it takes 7-10 days to return the money back.” But I need my money back immediately. I am not responsible for the bank’s mistakes, plus return all the fees. Bank of America must contact with my PNC bank and solve this problem. They got very poor service. Economic damage: $635.90 plus all fees.

February 6, 2010 Complaint: They have whited out my original information on the refinancing application on august 24, 2006. They have inserted their own lies afterwards - such as: My monthly income was at that time: $1,600.00; From a temporary job as a customer service; They whited it out and put that I made $8,527.00; The value of my house was as per the town of Oysterbay, Nassau County, Long Island New York $312,000. They inflated the appraisal to be $512,000.00 then they lied about the years I worked in the company. It was 8 months they stated that it was 4 years. They lied about the name of the company I worked for, it was Prudential Mortgage, Plainview, NY. They stated that it was "Neptune Office "Planiview, NY"
Then they continued lying throughout the entire application. When I signed the application in front of my attorney: Yvonne **, of Farmingdale, New York, she verified all the information line by line on the application. It was correct, then she would have never allowed me to sign anything that was not correct. Her license was at stake, we asked them for a copy of the signed application but they refused to give it to us at the time of the signing.
2 years later, on July 2008, when I finally obtained a copy of the falsified application from Countrywide, we realized what they had done. It was too late, they lied to me in order to get me into a (conventional) I couldn't afford (according to my financial documents such as W-2. Knowing that I couldn't afford a conventional, I asked them for a reverse mortgage which I qualified for at 64yrs old. My house was totally paid for and I passed the requirements according to the government. They lied to me and let me and my attorney believe that they would give me that reverse when at the end they switched and faked it into a conventional at 8.5% adjustable). They lied to me (my lawyer stated in writing) and that they falsified and tampered with my documents and lied to me from the beginning till the end.
I have all the proofs! Today they are refusing to modify my loan according to President Obama, making home affordable though I qualified. I'm stuck in an 83% of my income mortgage paying interests. Only then this loan will balloon to 11% then 15%. They stuck me into a sub-prime that stated no docs. I presented them with all my proofs of income, W-2 for the year 2006, adjustable option arm (I only had one primary home- I had no other business income from other houses to allow me play ping pong with the profits of the adjustable rates from other investments. I had only one home ) of 8.5% from one house to the other.

Our monthly mortgage payment is currently $722.74. After receiving some additional money as a gift for Christmas, we made two (2) monthly mortgage payments to BAC Home Loan via online payment from our bank (online banking) in the amount of $1,445.48. Said payment was debited from our account December 28, 2009 and was noted on our BAC Home Loan Transaction History as "12/29/2009 Misc posting of $722.74 and 12/29/2009 Payment of $722.74. " Only $306.58 was posted to principal, $227.63 was posted to interest, $188.53 was posted to Escrow, for a total of $722.74. The remainder was posted to partial and remains there today.
Emails to BAC have been ignored. Calls to various departments at BAC have also been either ignored or re-routed to other departments without response. In addition, our loan is continuing to be carried by BAC as a 30-year Conventional Loan, a fact that is totally false.
This loan is, and always has been since November 30, 1988, a Veterans Administration 30-year Guaranteed Loan. Bank of America Home Loans is denying us the correct amount of legal mortgage interest paid during 2009. Additional irregularities have been noted in the posting, processing and handling of our loan since 2001 when this loan was assigned to Countrywide Home Loans and then Bank of America engulfed Countrywide.

A tree fell on my house in mid Oct. The insurance company paid B of A on the claim within 2 weeks. I paid $1100 out of pocket to have the tree removed, which the insurance company paid to B of A to have me reimbursed. I have received no check or payment of any kind. It is now February. No work has been done or needed repairs because they won't release any money. I've had to fax various documents 5-6 times because they kept claiming they never received them or couldn't read a digit, letter, etc.
There have been multiple times they said they had all the required paperwork to disburse funds and give me an approx. date to expect a check. I call to follow up only to find there is some new issue and or no record of anyone ordering a check. There are countless excuses. This has been the very worst experience of my life. I actually went into a BoA banking center and had the manager fax the paperwork again. They tell me one thing on the phone, notate something different to cover their ** if I question what I was told.
I'm scared I'll never see the money and my house won't get repaired. They are negligent and there is no one to hold accountable. How do you keep losing my paperwork? How does one rep read to me what I sent over, and the next day, a rep tells me it's not in my file? I have received so many different answers from B of A claims about how long it takes to have a vendor ID set-up. I still don't have a check, just excuses about the processes. I have been told "it takes time".
Be prepared for the runaround. There is no customer service. I've had some nice reps from B of A but nothing changes. You have to wait for a vendor set-up. You get different answers on the same day when placing more than one call. Something needs to be done. I was finally given a date that I could expect the reimbursement check and planned on part of the money to make my mortgage payment. I have had my loan modified and am on a three month trial period to demonstrate I can make the new payment amount on time. Well, I now can't make the very first payment due to their ** and am in jeopardy of losing my home. In addition, the weather has changed and there is a good chance further damage will result due to the repairs not being done.

I had a mortgage with Country Wide Home Loans, and BoA purchased them. I have had nothing but problems since. I received a refi on my loan, and I have been paying my payments the same time each month, the first. And I have been paying extra each month with that to be applied to the principal. But when I got my statement in January 2010, I see that not only are they taking the extra amount each month, they are not applying it to my principal. It just seems to disappear. That is $200 a month just gone. Isn't that creative financing at its best?
And they charged me a late charge of $71.00 for February when they receive the payment before it is even due. So what is that? Another creative financing skill they seem to employ. When I wrote asking about them, they make up some crap about this and keep taking my money and putting it who knows where. I want my account updated with the extra funds I pay in and any late charges removed. But it is taking me months to get that clear through their heads. They stink as a bank!

I have been making timely monthly payments on my HELOC account via my banks bill pay service. Bank of America Countrywide refuses to post my payments to my HELOC in a timely manner. If the payments are posted at all, they are usually posted after the grace period and then I am charged late fees. Bank of America Countrywide then reports to the major credit bureaus that I am delinquent with my payments.
Because of this I have received numerous letters from my creditors increasing my interest rate on my credit cards, lowering my credit limit or closing my cards altogether. I have filed disputes with the credit bureaus and the response I get from them is that the delinquency is being reported corrected. When I call Bank of America Countrywide, I spend hours on the phone being transferred from one person to another. I get disconnected forcing me to call back. I get left on hold and no one ever comes back to the phone. The customer service reps all ask for my phone number to call me back in case I get disconnected, yet I never get a call back. I have even had some people refuse to help me stating that they can't do anything.
I have written numerous dispute letters to Bank of America Countrywide, yet this issue still never gets corrected. Bank of America Countrywide has been reporting me as being delinquent on my HELOC account. The credit card companies that I do business with have increased my interest rate on my cards, lowered my balances and closed some of my accounts. All stating that it is because of the new delinquency that has shown up on my credit report.
