    Reviewed Jan. 7, 2013

Dealing with Life Alert has been a complete nightmare. I've wasted thousands of dollars due to their greed. My aunt has some mental and physical problems and was required to have Life Alert equipment for about 3 months. After the 3rd month, she was moved into an assisted living facility and didn't require use of the equipment. I called Life Alert and was told that I had to keep the equipment for 2 years even though we had no further use for the equipment. Of course I was upset, but I felt I had no choice but to keep the equipment for 2 years.

When 2 years was up, I requested that the contract be cancelled. To my disappointment, I was told that the contract was for 3 years instead of 2. In September or October of 2012, I called again and was told that the last payment would come out at the beginning of December 2012. To my surprise, I found that another payment came out the first week of January 2013, and that Life Alert would continue to take payments from my account until the equipment was returned. You see, even though I've been paying for services for the last 3 years, Life Alert has deemed it necessary to send correspondence to my aunt who’s not mentally capable of making any decisions either for herself or anyone else. My aunt told Life Alert that she preferred to keep the equipment, and they went along with her decision even though I told them I wanted the contract cancelled.

Also, since I’m paying for these services, I feel that all correspondence concerning payments or contractual decisions should have been sent to me. I’m not rich, but I feel like I was doing the right thing by supporting my aunt financially. Now, I’m out of thousands of dollars. I forgot to mention at the end of the 2nd year, they told me I could end the contract by purchasing the equipment for hundreds of dollars. Also, instead of letting me return the equipment after my aunt was moved into the assisted living facility, Life Alert just stopped payments for the months of February and March 2010. After paying over $2,000.00, the equipment should be mine. I’ll never do business again with Life Alert and will discourage others to refrain also.

    Response from Life Alert

Life Alert is concerned over the perceived events listed in this complaint since our contract and standard operating procedures different vastly to what the complainant is claiming.

Life Alert takes its role in saving lives very seriously. Unfortunately in the past, family members had cancelled this life saving service while their elderly loved ones still needed it; and it led to seniors not getting help in a timely manner.

Our protocol is to ensure the safety of the senior and to be certain that the customer will be protected after cancelling our lifesaving service. In order to do this, Life Alert has a cancellation clause which states if the customer needs to go into a health care facility that all the family need do is ship our equipment back to us and have that facility fax us a confirmation, and the customer will be released from the agreement with no penalties.

This clause is clearly stated in the agreement and is explained during the initial phone consultation with a representative. In addition, when family members call to tell us that their relative has been moved into a health care facility or have 24 hour care at home, we also reiterate our cancellation clause to them, and do our best to accommodate their needs and to get the faxed confirmation to us a.s.a.p. so we can release them from the agreement.

This complainant is stating that her aunt moved into an assisted living facility and no longer needed our services. This would definitely qualify to be released from the agreement. No charges would have been incurred if we had received the equipment and a faxed notification from the assisted living facility. All of this is stated in the original phone consultation with a representative, as well as in the signed agreement by the customer. Additionally, a copy of the agreement is sent with the equipment and the family member is told this when calling to inform us of the customer’s move into a health care facility.

Moreover, the complainant claims she was offered to buy the equipment for hundreds of dollars, which is not possible since our equipment is not for sale but on loan for free for the duration that the customer uses our services; we only charge for the service we provide. This is why we need to collect the equipment first (and we pay for postage) before the any agreement can be finalized. Therefore, we are requiring that this complainant contact us immediately at wecare@lifealert.com with her aunt’s name and phone number, or the account number, so that a thorough investigation can be performed.

The sales associate hung up on me. I work in technology and know how these systems work. I was trying to get pricing and other information. The associate was insisting he needed to 'educate' me. Then he took a deep sigh, told me to have a nice day and hung up. Trust me, I'm telling everyone not to use this company. If the front line sales associates behave in this manner and are allowed to do it, then the remainder of the company must be just as bad.

We are sorry you feel that a sales associate did not treat you correctly. Our sales associates are trained to explain all the different plans Life Alert has to offer depending on each individual situation. We also train them to be respectful with the callers, and not to do hard sales. From your testimony, it appears that the representative felt you were uninterested in buying our service, and thus wished you a nice day and terminated a call as to not waste your time, or being accused of doing a hard sale.

My mother is 82 years old. She has memory problems, and they are getting a wee bit worse as time is going by. She also is falling more as time passes. She has had Life Alert for 3 years and has used it upon more occasions than we like to admit but glad that she had it until recently. She was very much together when she got the contract and was good about testing the device monthly. In the last year her memory hasn't been so good, but her falling has been on the increase. She has been taken by emergency services 7 times in 9 months to the ER for falls. Life Alert has been used through most of them. Sometime in February 2012, she fell again. She did not tell me because we had a talk that if she continued to fall like she had, she would not be able to continue to live on her own.

At the end of April 2012, on a Friday night, my husband and I checked on her and her cats; everything was fine. We left and went the less than 1/4 mile home. We went back down to her home Saturday afternoon to check on her and see if she wanted to come down to dinner. My worst nightmare came true. She was lying on her bathroom floor and had been there all night and throughout Saturday morning. Her Life Alert pendant button didn't work. She was a mess. We called 911, and without moving her, I cleaned her up as best I could before emergency got there. She was in terrible pain. They had to roll a towel and secure her neck before putting her on a backboard then the cot. She was transported to ER for CT scan and all other necessary testing.

She had a break to her C1 vertebra. This vertebra controls everything. It is the one that they break when hanging someone to kill them. She is one lucky lady. She had to be transported down to Saginaw, MI for a Neurosurgeon to perform surgery. After she arrived in Saginaw, a MRI was performed. And not only did they see the one break, but they found 2 more; and once he got into the neck, he discovered that this injury was 2 months old because it was already beginning to heal. Bone was already growing over the breaks. The following day, I asked her when she thinks she fell and hit her head so hard to have broken her neck. She said she has fallen in February 2012, and when she pushed her Life Alert, nothing happened. I asked her why she didn't tell me. She said she forgot. So she walked around for 2 months with a broken neck.

When I pressed her button once I got back home, nothing happened this time either. When I called Life Alert to cancel the service, the person I spoke with (I don't remember the person's name) asked when was the last time she has done the self-test. I stated that I wasn't sure. Then, this person put me on hold and came back and said that she hasn't pressed the button since the end of December 2011 and in the contract, if you read it, it states that she must press the button once a month. My reply was “She is 82 years old. She has a history of falls and you didn’t even think after a month of no button being pushed to call her.” Her response was “Our system isn’t sent up for that”. I told her that maybe you should update your system so that when a customer who has a history of falls and is older - and you are withdrawing their money every month - doesn't press their button for a check after a month, maybe, just maybe, you should call them. It is called good customer service.

Now, not only am I dealing with a father in long-term care who thinks he is in WWII, my mother has a broken neck and probably will never be able to return to her home again. I will have to deal with the headache of Medicaid, the mountain of debit that is coming this way from the entire medical, and my own guilt that my mother laid on her bathroom floor for 20 hours in her own waste and in pain because her Life Alert didn't work and it was her fault that she's 82 years old and didn't remember to tell me that she didn't push the button and it didn't work. Whatever happened to common courtesy? Has the almighty dollar become that important that preying on the elderly is what people do today!

As for an update, my Mom died on November 15, 2012, as a result from complications from her breaking her neck. She never recovered from the injury. Do I hold Life Alert directly responsible for my Mom's broken neck or death? No. Do I hold them responsible for the degree of her pain and suffering? Yes. If they had taken the caring and time to call her once or call me, the person listed for emergency, just once when she didn't push that damn button for one test, to ask me if something was wrong or even if she was dead, she would not have laid on her bathroom floor for over 20 hours in her own waste and in such terrible pain. If they would have cared about the person even just a fraction as much as they do about the monthly payment, she would have gotten help a heck of a lot faster than 20+ hours. That may have made a difference.

There are so many could of, would of, maybes, and so forth. The one thing that is a given is that this company puts Greed before human care. The person that I spoke to when I called Life Alert, she was rude and uncompassionate. All she could say was "You need to read the contract”. Well, excuse me. I didn't sign the contract, and the person who did is lying in a bed hooked to all types of tubes and wires, and we don't know at that point if she will be able to move, walk, breathe, eat, talk or better yet live; and you are berating me about not reading a contract. Well, I hope no one ever has to go through this type of awful experience in your lifetime.

I lost my father on July 27, 2012, and now I have lost my mother on November 15, 2012. I will never recommend Life Alert to anyone. There are other devices out there that will call the customer to check if they don't get a check-in. Life Alert doesn't even care to know if the person is alive or dead as long as they have access to the credit card or bank account for payment.

    Response from Life Alert

We here at Life Alert are saddened to hear about your mother and are truly sorry for the loss of both your parents in such a short period of time. We understand how difficult of a time you must be going through right now and sympathize with your situation. Please know that our thoughts are with you.

Life Alert would like you to know that we performed a thorough investigation into your mother’s situation, and have discovered that on December 22nd, 2011, your mother’s button was pushed in error but it was still working at that time. However, we did not receive an emergency call in February or April, as you already know.

When customers sign up with our service we explain in detail that it’s important for them to test the pendant monthly and to either put a reminder on a calendar or ask a family member to remind them to test their pendant. However, we understand that sometimes people may forget to do this that is why we have a backup system in place that notifies us when a pendant’s battery starts to go low.

According to what your mother told you, when she fell in February she pushed her button but nothing happened. We have searched our database and your mother’s system did not trigger an alert nor did it warn us of a low battery.

Sometimes, an elderly person with memory problems may think s/he have done something, such as press an emergency button, but actually forget to do so; or they may intentionally not want to seek help for fear of being seen as no longer independent and having to be removed from their home and placed in a retirement home.

It can be emotionally, physically, and financially challenging to adult children when an older parent has memory and balance problems, and we truly sympathize with the family challenges you and many other adult children face with aging parents, and understand that perceptions may be a bit disoriented at times of stress, worry and mourning but we hope you will come to understand that we do care about our customers and their families too. That is why we have contracts in place, not as a form of greed, but as a form of protection for our customers and their family. Though some companies may promote “no contracts” this may not be in your best interest. If you have a contract with a company they must uphold their commitment to you. A contract is your price protection so you’re guarantee a fixed cost and the company can not raise their monthly charge or implement hidden fees like other companies do without contracts.

Moreover, those other cheaper companies outsource their dispatch centers, meaning, a third party answers the emergency call. This removes the medical alert company from having control and responsibility.

A company that has their own dispatch center, like Life Alert, is a company that reinvests in the client’s safety because it continuously upgrades security technology and qualified personnel. Moreover, the dispatch personnel are more apt to be personally invested in the success of the company, by saving lives, based on their abilities. If the company has a dispatch center on site you know they are a strong and secure corporation that didn’t just pop up over-night and won’t be gone in the morning.

We understand that all we are saying here means very little to you during this difficult time, but please know, we truly are sorry for your loss.

    Response from Life Alert

Life Alert takes its role in saving lives very seriously. Unfortunately in the past, family members had cancelled this life saving service while their elderly loved ones still needed it; and it led to people not getting help in a timely manner.

In order to protect our customers, Life Alert has a cancellation clause which states if the patient needs to go into a health care facility that all the family need do is have that facility fax us a confirmation and the patient will be released from the agreement with no penalties. This clause is clearly stated in the agreement and is explained during the initial phone consultation with a representative.

We are sorry that this family member is having a challenging time with faxing us a notice from the assisted living facility but we do hope that she understands that this is a precaution to protect her mom.
