In Dallas, hot tubs are regulated by the same laws that govern swimming pools. The Texas Health and Human Safety Code defines a pool as any permanent swimming, wading or reflection pool or permanent hot tub or spa more than 18 inches deep.

Inground pools and spas in Dallas typically require a permit, but prefabricated hot tubs do not if they have a capacity of less than 5,000 gallons. You can obtain a swimming pool and spa application checklist from the City of Dallas, and download a pool/spa permit application.
