    I purchased a vehicle and have had it for three years. I have made at least 19 payments on it and they are trying to say that I still owe $13,688.00 The total loan with interest added in was $14,056.71.00. There is no way I still owe that much in the papers. It says if you’re late, you will be charged a 1 time fee that month of $15, but now they are saying that it is an everyday interest charge. I need some help. My grandpa looked over it and said they were wrong that my papers don’t say any of that, and he said contact Consumer Affairs, so here I am. I had to file for bankruptcy and I need the van, but I don’t want to pay $35,000.00 for a 2005 used van! Plus, they never honored the warranty on the van! They haven’t fixed any of the problems with it from the start!

    I received a message from a girl named Jeannie. She said she was looking for Claudia ** or Stephanie ** and to please call 888-. I called the number, but I could not be connected to that person for whatever reason. I asked to speak to the collections department, and they said they couldn't do that. I told them the person they were looking for was my ex-sister-in-law and that I knew she lived in Maryville, TN but that I did not know her phone number. I asked her to please stop calling my number.

    After several minutes, I became upset with the person and asked to speak to the supervisor. I asked for the name of the company and the address. Then I asked for the name of the head of the company, and she said "I can't provide you with that information." I finally gave her my phone number to see what account it was linked to, and she said nothing came up.

    Again, I told her that someone called me, and I want them to stop calling me. While she had me on hold, I looked up the company on the internet and found a totally different address than the one she gave me. And I also looked at a site that had complaints on it about this particular company. I am a consumer who pays my bills on time, and I am extremely annoyed that a company like this could, in all probability, get my phone number off the internet. And because I used to be related to this person, they feel they have the right to call my home to inquire as to their whereabouts.

    I had a similar call a week ago, not from the same company, but from a debt collector, looking for my ex-husband. When I answered the phone that time, they asked for "John." I said he's not here right now and if I can take the message. They said, "Are you Mrs. **?" I said no. And the girl said, "You just said you were his wife." I replied, "John is my husband, but his last name isn't **." Then she grilled me about where my ex lived, worked, etc. And they had to have gotten my number from the internet, because I haven't seen or talked to him in over 20 years.

    For about the past two years, I got calls from "Santander Consumer" for my ex-husband. Sometimes, the calls showed on caller ID as "Drive Financial." They are relentless with their calling. This telephone number has been in my name exclusively for a few years. They left messages for my ex. The call-back number left does not have an option to speak with anyone, unless you are a customer, which I am not.

    On a few occasions, I have spoken with this "Matt **" directly. I have explained that this is not my ex's number and that he doesn't live here and hasn't in a long time. Further, there will not be a time when he will be able to contact him with my information.

    I have repeatedly asked him to entirely take my number out of the database at his company. I have filed a couple of complaints at the "donotcall.gov" website without avail at this writing. I returned home from work last night, and there were a total of 8-9 calls from this company. The last time I spoke with a "real" person ("Matt **") at this company was about 2-3 weeks ago.

    Usually when you hear about someone being "kept", it is a woman that is the topic of the discussion. I, the woman, had the interesting experience of divorcing my "kept" husband, whom I worked 2 jobs to "keep" in the best clothes, motorcycle, big truck, and daily runs to Starbucks that my money could buy. Needless to say, after our divorce, he immediately filed bankruptcy and left me with all of our joint marital debt. I was unable to keep up and had to file for bankruptcy myself. Of course, that wasn't until after he had my truck repossessed. I was completely humiliated.

    I managed to get a loan for a new vehicle through Santander Consumer. Although the 24% interest rate placed my payments at $6 below what I paid for my house each month, I was happy that I had a vehicle and that it belonged to me. I filed bankruptcy, but continued to pay for my house and vehicle. I wanted to make it through the bankruptcy with those intact. Learning from a bad financial situation with my ex-husband, I began checking balances on my loans almost monthly. It motivated me when they went down, even the smallest amount. I took credit counseling courses and took to heart the importance of a good credit score. Needless to say, I am a reformed "keeping-a-holic".

    After my lawyer filed for my bankruptcy, I went to the Santander website to log in and check my balance/payment information. Instead of my account information, a nasty message appeared before my eyes, with a number to call if I had questions. I called the number and was immediately turned over to the Bankruptcy Department. At first, they did not want to talk to me about my account. It took a lot of talking, on my part, and the threat of contacting my lawyer for them to talk to me at all. As it was explained to me, I wasn't permitted to access my account information, because my account was in the Bankruptcy Department, pending discharge. I made it very clear that I was going to reaffirm my loan with them and would continue to make my monthly payments. The lady on the phone said that as long as I did those two things, my account information would be restored for my viewing, once the bankruptcy was discharged.

    It seemed like forever going through the process of bankruptcy. I don't know if you've been through it, but it is very stressful. Creditors become very spiteful when you file for bankruptcy, regardless of your situation or why you had to file. Eventually, in January, the bankruptcy was discharged and my stress had ended or so I thought. Today, March 1, I did my yearly review of my credit report and noticed that Santander was no longer reporting my account. I was a bit frustrated by this, because not only was I making the payments, I was paying a little extra each month.

    I again attempted to access my account information on the Santander website and, again, received the same nasty message. I contacted the number that appeared on my screen, where, again, they did not want to talk to me about my account. This time I talked to Alex (who would not furnish me with a last name). At first, he wanted to know why I wanted to look at my account. I couldn't believe that he was questioning me as to why I would want to look at my account information. He eventually told me that my account was still in a pending status, awaiting the discharge of my bankruptcy.

    I told him that the bankruptcy had been discharged back in January and prior to that, my lawyer sent in the reaffirmation agreement. He immediately put me on hold. Approximately 15 minutes later, he came back and said that they never received a reaffirmation agreement and since none was received prior to the discharge of my bankruptcy, then he couldn't talk to me about the account. I reiterated that my lawyer had submitted one. To this, he responded that I should have my lawyer call and talk to them. At that point, the conversation was over.

    I contacted my lawyer, who called them immediately. About an hour later, my lawyer called me back. At first, he received the same runaround that I did. Eventually, he spoke to someone who claimed they were "in charge". The "in charge" person stated that they did receive my reaffirmation agreement, a month before the discharge of my case, and it sat on the approval authority's desk, unsigned, until after bankruptcy had been discharged. Since it was not signed before the discharge, it's as if it didn't exist.

    At this point, legally, Santander can come and repossess my vehicle, even though the error was theirs and I am current on my payments and paying extra each month. Now, I have to try to refinance my vehicle. My credit score is fair, but no one wants to touch someone who was recently discharged from a bankruptcy. Until I can find a lender to refinance me, I get the added stress of living in fear that I get up one morning and my vehicle has been repossessed.

    According to C.L. ***, a misplaced payment matter was supposed to be resolved as of 12/14/2009. However, I have been receiving continuous harassing phone calls about the payment. My bank has forwarded all necessary documents which proved the payment was received and applied. I have contacted Consumer Affairs concerning this matter, after receiving a phone call from SCUSA at 9 pm.

    I have been receiving harassing phone calls concerning one of my accounts. The matter has been resolved, however, the company continues to call me at home and at work. My rest has been interrupted by these continuous phone calls. My work has been interrupted by these continuous calls. I receive calls as late as 9:00 PM.

    My monthly payment is $331 per month. I always pay $402.88. Santander never posted my extras payment to my principal balance because they say they are a different company. The customer services named Crist was very rude with me and treated me as if I had a bad credit. That's was not very nice from him also. He said because my credit was bad, they need to charge me a high interest rate. My loan is from 2005. I still owe $15800. Please anything we can do to sue them in group? There is no one who can talk with them because they are very rude.

    I have been with Triad Financial for a long time and I think they got bought out by this company. I have been late with my payments for the first time due to a cut back in hours at work. They promised me an extension if I promised to come up with an X amount of money and when I came true on my end, they said that they couldn't give me the extension because I haven't worked with them long enough. The individual whose name was Rafael was extremely rude and threatened me with taking my car away. I hope someone can really do something about these people because that's not how business is conducted. The constant calling around the clock is also getting old.

    This is a huge problem. I do not have a loan or anything with these people. All I did was lend my phone to a young man to use and I have been getting calls from this collection agency ever since. I keep telling them that I am not the person they are looking for and they told me today that if I lent my phone, I must know the person and how to get hold of him. I told the caller that I do not and will not take any messages for anyone.

    These people call me after 10:00 pm, seven days a week and before 8:00 am on weekends. I told them to remove my phone number and not to call me again. I finally told one lady that she is harassing me and that I am going to make a police report if she did not stop and she just told me to go ahead and hung up on her.

    Any time we are a few days late, they will call to ask us to pay over the phone. I don't mind this. My problem is they have been calling a co-worker of mine for the past three weeks. I used her phone once to make a payment and I guess that's how they got her number without my permission. I called them to remove it once and she was still getting calls while we were not receiving any. I finally had to speak to a supervisor. She said that I had to have my co-buyer permission to remove them, so I handed him the phone. He said, "hello", then she replied, "why did she give you the phone, I don't need to talk to you", that she needed the co-worker's number, so I had to get the number back and hopefully she doesn't get anymore calls .This company has some serious customer service issues. I don't understand why they would have such a hard time fixing something that should have never happened to begin with. I hope I don't have any more trouble with them in the future.

    On December 4, 2009, I paid off a Historic 1917 Buick to Sovereign / Santander Bank. Having never received the Title from Sovereign, I called February 2, 2010 and to no avail I was told, "There is nothing we can do for you, the Title is in the mail." I asked if they had proof of mailing and was told again, "There is nothing they can do for me, the Title is in the mail."

    I spoke with another manager who said, "They don't need proof of mailing and they have no proof of mailing, but will send me a release form, and that I will have to pay for a duplicate Title." I insisted they take responsibility for their action and was told, "You're on your own, the Title is in the mail." In other words, they told me to get screwed and will not do anything to recover the Historic document. Sovereign Bank will not accept responsibility. Historic original car Title lost worth thousands of dollars for resale with vehicle. Avoid business with Sovereign Bank, they act in bad faith causing grief with no remorse.

    I fell behind on a few of my car payments due to being laid off from my job in September of 2009. I have been paying what I could each month and have spoken to several people from Santander. On December 4, 2009, I made a payment and was told by the representative that I was only 17 days past due and would be okay until my next payment in January 2010.

    On January 17, 2010, I went online to try and make a payment of $350.00, which was my payment. It was showing I could not make a payment unless it was $645.50, plus the ridiculous $10.95 payment fee they charge to make a payment online or over the phone. I honestly did not have the extra $10.95. I was putting everything I had into the payment. I spoke to someone over the phone and explained this, and was told there was nothing I could do. I had to make the full payment. I was going to wait until the following week when I got my unemployment check to do the remainder.

    Lo and behold, January 26,2010 comes around and my neighbor called me at 3 pm and told me if there is anything in my car I want, I better go get it because they were taking my car. I went outside to talk to the truck driver and told him the situation, and he said there is nothing he could do. I did ask where the car was going, and he told me the place doesn’t have an address, and it was in north Kansas City by the airport, which is about 45 minutes away.

    I immediately called Santander to see what I had to do to get it back. I was told by a representative that to get it back I would have to pay $1330.45. I then asked the best way to make a payment and how long it would take to process. She told me the best way to pay was through MoneyGram because it could be processed right away and they could release my car in an hour after payment. If I paid by debit card, she told me it would be the next day before they could release it. I then informed her I would pay by MoneyGram in the morning.

    I called my old boss, got my W2s and went to file right away that night so I could get my taxes back the same day. In the morning, I had set up with a friend to come get me, so I could pay and go get my car. I called Santader first thing in the morning and spoke with the first nice person I have ever spoke with to make sure I had all the details right. He told me first that the payment due was $2078.62, and I told him that the night before, I spoke with someone and he told me it was $1330.45. He told me that was wrong and it was indeed $2078.62. Irritated, I said, “Whatever, just tell me what I need.” He then informed me I could pay with a debit card and still have it released within an hour.

    I asked him several times, “Are you sure?” And he replied yes. So, I asked him to please double check with his supervisor. He put me on hold for a few minutes, coming back with a confirmation of what he said. Okay, cool, this was getting easier for me. Yeah, right. I made the payment of $2078.62 with 2 separate debit card transactions on my MasterCard with the wonderful $10.95 fees. I got my confirmation numbers and he transferred me to the reinstatement department.

    Wonderful. Gracie, in the reinstatement department, who is extremely rude and snotty informs me that I can’t have my car back until the next day. I told her, no, I was told by the representative before and he checked with his supervisor that I would be able to get it that day within an hour. I went rounds with this rude Gracie girl while she was informing me that the other departments didn’t know how things worked in the reinstatement department and they were wrong. I asked to speak to her supervisor or whoever was in-charge, and she told me nobody was available. For at least 15 minutes, she told me that there was no way to get the car back that day, and I would have to wait.

    I asked her one last time, “So, there is absolutely no way I can get my car today?” She proceeds to tell me that the only way I could get it back today is if I paid via MoneyGram and they could cancel my debit payments. I told her that’s what I was asking the whole time! I told her to cancel the debit transactions and I would go immediately to MoneyGram. She gave me authorization numbers for the cancelled transactions and noted in the account I would pay that day. Immediately, when I hung up, I called my bank and explained the situation and made sure there was indeed the reverse transactions. They did show up, but with an expiration hold date of February 28, 2010. My bank informed me that the merchant (Santander Consumers), put a hold until then on the transactions. That was another deal, as soon as I got my car back.

    Luckily, I had my taxes back so I could afford to pay the $2078.62 through MoneyGram even though it broke me. This all happened at 9 am and after being given the run-around on getting my car back, I finally got it back at about 4 pm after paying the truck driver $100 for 2 days storage (it was barely 24 hrs) and some other fee. It is now February 1, 2010 and I am still fighting Santander to get me $2078.62 back from my debit transactions. I was told on January 29, 2010 by another representative that the reinstatement department manager, Tara ** guaranteed me that the money would be in my account on the 29th, or at the very latest the morning of February 1st, 2010. Still, I haven’t seen it. They are holding my money hostage! This company is horrible!

    On January 14, 2010, I made my January car payment, which was due on the 15th. On the 21st, the payment cleared my bank account. On the 25th, I received a call from their collections department, stating that I never sent a payment. I explained what happened, and they said I should fax a copy of the canceled check to their accounting department. I did so the same day. Today, I received another collections call at my work (!). I calmly explained to that person what happened. The response I got was, "when can we expect a payment". I told her that they could expect the February payment in February, when it is due. She asked when they would get the January payment.

    I explained things again slowly, thinking perhaps she did not understand. After the second run-through, she asked again when I would be sending a payment. I then asked to speak to a supervisor. I was told all of them were on the phone. I told her I would hold on. Then she asked, "why do you want to speak to a supervisor?" And I told her that obviously, she had difficulty understanding the situation, and perhaps another person could understand. She said, "oh no, I understand." I said that didn't appear to be so, and I would wait until a supervisor was available.

    Eventually (15-20 minutes later), Theona came on the line, and identified herself as a supervisor. I explained the situation again. She said she would contact the accounting department, and find out the progress, and in the meantime, she would put a request in my file to cancel all collection calls, until the matter was resolved. I thanked her. No more than 5 minutes later, I received another collection call from Santander on my cellphone. I told this person that I had just spoken with Theona, and that she should talk to her. I was placed on hold. Without coming back on the line, this representative disconnected the call several minutes later. At this point, only time and energy has been expended. However, if the matter isn't resolved in another few days, Santander will report the account as delinquent, damaging my credit.

    I had an auto loan that was closed since May 2003. July 2009, I made a settlement with the law firm assigned by Triad to handle the account named Mullooly, Jeffrey, Rooney & Flynn LLP at (516)-656-5300. The settlement amount was $6,000 at $1,000/month for 6 months. The last payment was Dec 2009. Santander was aware of this in Nov 2009 because I had spoken with Heather at Santander at 800-215-6922 ext 85050 and faxed her a copy of the settlement letter.

    I emailed Joe of the law firm about this and all he could say was that Santanter took over Sovereign Bank and Triad Financial and they, his firm, had not dealt with Santander but he would email me the paid in full letter, the next business day. I am upset because the Triad account cycled off all three of my credit reports already. Santander just came back on my Transunion as if a new account with no reference to the Triad account even though it has the same account, open date of 8/2001 as Triad. The account closed date is 11/2009 though which means the Santander info won't come off until 10/2016. How rotten! I do not think this info meets the Fair credit reporting act rules.

    I originally had my car loan with Sovereign Bank. They sold it to Santander Consumers USA back in May 2009. I paid the load off to Santander in June 2009. The loan was a 60 month loan that was paid off in 57 months. I recently learned that Santander reported me to the three credit agencies as being more than 120 days late with my payment. This was untrue. In fact, after I paid my loan in full they sent me the title to my vehicle. They would not have done this if I was late. I also checked my credit report for Sovereign Bank and they showed that all my payments were on time while with them.

    I was only with Santander for a couple of weeks before the loan was paid off. It's not possible to be 120 days late. I have spoken to numerous Service Representatives who have given me the run around. First a Manager lied and said I was late with Sovereign Bank. The next Representative told me they did not close their files out correctly and the notice to the credit agencies was an error. Since then, I spoke to numerous agents who gave me different information and was getting nowhere. My credit has been ruined and my score has dropped drastically. My credit card companies are either canceling my accounts or raising my rates drastically. I still have had no resolution.

    In November of 2009, I had fallen behind in payments and was, according to my most recent bill from them, two months behind but was due for a payment on December 21st. I contacted the company and said that I would be able to make that payment on the first week of January after my unemployment was deposited onto my debit card. I was awoken at 11 pm on the 2nd of January by a woman saying that she was there to repossess my vehicle and asked if I wanted to get my things out of it.

    I was taken completely by surprise for I had no prior knowledge that this was going to occur. No letter of intent was sent to my address. I obliged to the repo person and retrieved most of my property out of the vehicle and I asked if there was anything I needed from her or if I could have a copy of the papers she had regarding my repossession. She said no but informed me that she would contact the company and tell them that I was very cooperative and I was interested in recovering the vehicle and that I would also get back anything else I left in the vehicle.

    I contacted Santander the next day which was a Saturday and was told that my balance was about triple of what my last bill was for but there was nothing they could do to assist me because their Reinstatement Department was not open on the weekends.

    I contacted them the following Monday and was told that I had until the 13th to pay a reinstatement payment of $310 and they would hold off on selling the vehicle for ten more days if I could come up with a remainder payment of $909. I was informed also at that time that I would also have to pay for the storage of the vehicle but they didn't have that amount to give me. I had to sell some personal items to come up with the rest of the money but on the 12th, I made a reinstatement payment of $310.

    I wired them a Western Union quick collect payment on the 21st of $910 and when I called to give them the confirmation number, they gave me the number of the auction house that had my vehicle which was located five hours away from me. When I called the auction house, they informed me that my car was in fact there. It was five hours away from my location and I would have to come up with an additional $430 for the transport fee and because they repaired a couple small door dings on the vehicle. They also informed me that my belongings and plates for the vehicle were with the repossession company half an hour away from my home. When I called the repossession people, they said that I only have nine more days to claim my property and plates for the vehicle before they would dispose of them and I would have to pay them a fee of $55 to retrieve them.

    When I contacted Santander to get an explanation of why my vehicle was transported five hours away when I had been working with them the whole time in trying to recover my vehicle, I was given no answer. They were just telling me that they waived my $400 repossession fee and the charges at the auction house were not their charges. So now I am in a position to come up with yet another $500 to retrieve my vehicle which is at the other end of the state when all in all if they had let me know what all was going to be involved in this, I would have taken my $1000 I paid them and just bought another vehicle.

    I feel what they did was very deceptive and they were not forthcoming in the process or what was happening in my situation on their end. This whole experience has been a complete nightmare and I feel completely taken advantaged of when I did everything I could to work with them and give them the money they were requesting.

    As a single mother of two who receives only unemployment and no child support, I have been put into a situation where I can't even be in a position to find a job now. I have sold off personal items to make my account up to date and I am capable of continuing to make these payments but I have no idea how I am supposed to travel five hours away to retrieve my vehicle with an additional cost of $500 due to another company.

    I made payment on Dec 29, 2009 for $380 and when I went home and checked online, it showed a late fee of $34.82. I went on Dec 30 and made $36.00 late fee by Moneygram. The payment was not applied correctly. When I called to get it resolved, I was hung up on; the workers refused to allow me to talk with a supervisor. I called everyday several times a day. I did not get to talk with a supervisor still. I spoke with a rep on Jan. 4 and I was advised my account will be fixed so that the payment that was made would be applied correctly and was told to follow up in 72 hours. I followed up and then was told it was fixed. I was very upset at this point . I was given several different excuses why it was not fixed.

    Then again, I was told it would be. Several days went by and it is still not corrected. I then talk with a Amanget and was told it would be corrected and it is still not today . On Jan 15, 2010, I called Santander before making the payment of $415.00 of which $380 was for the regular car note and the balance to go to the late fees again because it is still showing late on my file. I was told it would be applied to the late fee that was still showing from Dec. I made the payment and I checked my account and now the same thing has happened and it is misapplied again. I was hung up on and several reps refused to give me a supervisor. I was getting nowhere; I waited the next day and tried calling to speak with a manager .

    I was placed on hold for 30 minutes and still did not get to talk with a supervisor; when I called back the office was closed. I called the next day and talked with a supervisor who assured me that this issue would be corrected. While today is Jan 19, and it is still not corrected. I will not pay anything else until it is resolved. Also I am filing a lawsuit against all parties involved. I have names, dates, and times I spoke with each person.

    The year 2009 was a very bad year. We had a death in the family and mother developed a stroke. The financial strain on my family put me in a position that I requested help from Santander, which bought my loans when they bought Triad Financial. I call to ask them to allow me to skip a loan payment, which was allowed in the old days. This was after over 30 on time payments without missing one. They told me they could not do this. I stopped all payment to their company from my bank.

    They did not start calling at first and was able to talk their rep into paying my bill for November 09 on December 15, 09. The next bill would be due on December 16. On December 19, they started to call 5 times a day, and I was only 3 days late. Anytime I talked to them, they were demanding to be paid and unwilling to help in anyway shape or form. I will not use these people again for any reason and if the choice of getting a new car means I have to deal with them again, then I will not be getting a new car. As of right now, I was able to pull funds together to get them caught up. I will continue to make these payments for fear of going through the stress I went through just talking to these people. They are very well versed in guerilla tactics and intimidation. I wish the government would take these Nazi-loving ** to heel and through a choke collar on this insane pit-bull.

    In January 2001, I bought a car from Connell in Oakland California and the finance company was Drive Financial Services. I paid faithfully until 2006 as contracted thinking that all balances were up to speed. My contract was coming to an end and I had spoken with Drive about the way the transaction ends and it was explained that my title would be sent to DMV after all is done and DMV would in turn send me a copy of my title. That was the last time I remember speaking with Drive Services. There were no bills, no letters, no other collection attempts.

    In early 2007, I was in an accident that rendered me disabled and in my haste to try to get some composure in my health, I endured a lot of financial mishaps but I did try to ensure that I paid any bills that came in despite being evicted due to lack of income due to my disability.

    On January 12, 2010 I was sitting on my bed and I heard a tow truck outside towing my car. I jumped up in surprise grabbed my robe and went out to check and the tow truck driver said that my car was up for repossession. I almost died, because I know that I have paid this car out to the tune of $16,000 in that matter of 5 years. The tow truck driver gave me a business card saying the he is from Extreme Recovery and that Drive sent him to repossess my vehicle. I took most of my things from the car and waited until the next day and started to investigate, realizing that Drive Financial was no longer in service and that 4 months ago, Santander Consumer Inc. bought the company out.

    I called on January 13, 2010 and was told that there was a balance of $1813.05 remaining on my car and I was told that I was very negligent in the way I handle my business and that basically they could have contacted me to get the balance but "Oh well, Angela you could have done better as well." I was then told that if I don't come up with this money right now then my car is going to be sold to collect $2563.05.

    I am feeling so helpless at the fact that anyone can come in and say that okay you paid more than $16K but for $1800 we're going to take it all back and there is nothing that you can do. I have put hard work and sweat onto this car and I have paid up all that I assumed was owed for this vehicle. I feel as if my livelihood has been challenged and I have literally been treated unjust. I feel that there is justice and I just don't know where to start. I have been severely compromised because my car is what I am using right now for doctor's appointments and physical therapy and to transport my children to and from school and appointments. I also am under medications due to doctors treatment for myself and for my son and my car is the way of assuring that we get our medications. My mobility is limited; I have to use a handicap sticker because I can't walk or stand for long periods of time so without my car, my interaction to the outdoor will be basically non-existent.

    I received the original auto loan through Drive Financial. The situation started shady and I shouldn't have went through with it. I was charged an outrageous interest rate and they tacked on additional charges, etc. but what can you do when you have to have a car and your ex trashed your credit rating? Drive was bought or taken over by Santander. Drive was bad enough, but Santander has been relentless. I fell behind (I know, my own fault) because of some major health issues as well as some even worse family issues.

    I started answering the calls, but they were pushy and promised to help when all they were doing is making you feel worse. They insist on a date for payment. When you explain to them you have been laid off (like a great percentage of the country) and I am working on employment, they want more than a payment plus the $10.95 fee. They push to use Western Union. I stopped answering the calls. I send in partial payments every week. I was recently contacted by the before mentioned ex, they called him wanting my information. I did not give him as a contact and in the middle of establishing a case because he molested my son. Them contacting him has created problems. I was keeping track of him through Facebook. He now blocked me.

    So now, his newly pregnant teacher of a wife is going to have to find out the hard way what this ** is going to do to the kid growing inside her as well as all the elementary kids that he now has contact with. I did not give them permission to contact this man, I did not give them his phone number (he lives in another state), I did not even indicate that I was related to him in any way. My last name has been changed. They told him that I was behind on my car payment. Now, they want to repossess. I tried to call the loss litigation guy with no answer, I tried to call and was disconnected. I am seriously thinking about obtaining an attorney.

    I to have had rude experiences with Santander Consumer USA, I also had the same rude experiences when this company was Drive Financial. I had my car repossessed just this morning at 3:30 AM. If it had not been for my neighbor knocking on my door, I would of never known. I have dealt with this company for the past two years and it has been nothing but a nightmare for me.

    Every time that I call, I never get the same person, and they all give you a different answers as to how to resolve any difficulties that you may have making your payment on time. I have done my best to stay current with my payments, but they do not seem to care about anything except getting their money. What I do not understand, is if they are really customer orientated, they of all companies should understand the economic crisis that our country is experiencing at this time, and be more understanding of everyone's situation, because none of them are the same.

    Trying to get through to any one other than a customer service rep is almost impossible, and it does not help when you get a hold of a ** supervisor, that calls you back, because you hang up on them. That one I just do not get. Then I was asked why I have not called since September of last year. There is nothing in the contract that I signed when I got the loan in the first place telling me that I have to call them at any point and time. I do not call them when they call purposely because of their ** attitude. I am glad to see that I am not the only one that is so very much dissatisfied with this company.

    Now, I not only do not have a vehicle, but now I can not go to work to try and make money to try and get back on track financially. They do not understand and do not want to understand that if you repossess a person's vehicle, that, that alone causes another problem, that it prevents from trying to find other employment that would offer me more hours, to get me back on track financially. One obviously affects the other. They just don't get it. They are just another money hungry company, and the hell with customers.

    I could go on, but I think by now anyone who will read this gets my point about this company. The best of luck with the rest of the poor individuals who are in the same situation that I am in. But I may have a way out of this. I am half tempted to tell them to keep my car. It is a piece of junk anyway. Besides if I do let them keep it, they by no means get what it is worth at an auction, that's my justice.

    My loan too was sold to this bank for a car my 23-year-old son has been making payments on. Last night, he was in the car dealership, trying to buy his very first car on his own. He spent 7 hours negotiating the deal. (I know it's a little lag, but hey, it was his first time.) The only thing needed was the title. He had $400.00 left to pay the loan off. It was 8:00 at night. He called me for help. I conferenced him in on a call to this bubble gum bank. We wanted to pay the balance off that night with a credit card.

    The CRS supervisor said we were not able to pay a car loan off over the phone, that if I was in a hurry, I would have to actually Western Union them the money. I live in BF nowhere, so the nearest facilities was like 20 miles away. And after that, she did not give me a definite time frame of when the title would be sent to me. She said a week, but was that 5 business days or 7 business days?

    I kept asking her if there is anything else that she could do to help us. But all this ignorant supervisor would do was read her "script." My son finally begged for her help. She would not budge. (I did work out something with the dealership, and he was able to drive the new car away.)

    This bank **! There was even another incident the first day they changed over which caused me an hour of my time to communicate to them that they were inaccurate on my account. Stay away from this two-bit operation. Their customer service is not knowledgeable and not helpful. I think your best bet that if your loan was to be sold to this trailer park bank (and don't mean to insult anyone living in a trailer park)... I would take out a loan from a reputable bank and pay these smucks off.

    The dealership is paying the loan off. I hope this bank is capable of closing this loan properly and doesn't destroy my credit in the process. Customer, beware. 5 thumbs down!

    I co-signed on a car loan with my wife in 2007 for a 2004 Chevy Trailblazer. Last year, I lost my job and my wife broke her knee cap so we got behind on a few payments. My wife, Terry, called and talked to Ms. Gwen ** and they had a verbal agreement on the payments. My wife has been making payment directly to Ms. **. Ms. ** gave Terry her personal line to call her payments in. Terry last spoke to Ms. ** on Nov. 16, 2009 to make a partial payment. Terry also made a full payment on Nov. 6, 2009 per Ms. **'s request. Terry and Ms. ** agreed on Nov. 16, 2009 that on Dec. 15, 2009, another full payment would be made.

    They also agreed verbally that two payments were going to be made in January to defer the loan to help us out on Dec. 15, 2009. Terry tried to call Ms. ** on her direct line while she was at work but could only get her answering machine. She had left numerous messages but Ms. ** never returned her calls. When I got up the next morning, Dec. 16, 2009, to start her car, it was gone. We began to call the police and they said it was reported. We were very upset. We tried to call Ms. ** but all we got was her machine. We began to call Santander and they said that Ms. ** was off and that we would have to pay to get our car back. We advised them that we had a verbal agreement with Ms. ** but they said that there were no notes about it.

    The people with this company is so rude. I do understand that these are high interest loans but the amount they charge us additional if you are late is terrible. They charge $10.05 a day that you are late. It is ridiculous. So on top of the interest you are already paying, they are charging outrageous fees. I am getting nowhere with my balance on my loan. They are a huge ripoff and should be put out of business. I have put $11,000 dollars into this car, making my car payments and only a $1,000 taken off balance. It is crazy. The people are very rude when they are talking to you and don't try to help at all. It just seem as if this car will never be paid off and I feel this is not fair. My husband lost his job in the summer of 2008 and it took us a while to get back on our feet. These fees should be against the law.

    Through various months, we have been asking about the terms and conditions of our loan. Not one employee with this company could provide an explanation. We are 3 months away from the loan being paid off and our balance is $2600 higher than it should be. Our payments have never been paid 30 days late but occasionally have been paid 5 days late. Santander finally advised the difference in the balance is penalties they apply per day for late payments. When you make a payment, they remove such fees from your payment and apply the remaining balance to your principal thus never paying your principal down and continuing to collect more and more interest from you. We normally pay $511.82 a month but now have been informed our final payment is going to be $3,122.77. They said if we cannot pay this in full, they will give us the option for a "Loan Remodification" which will charge additional interest. Even if we make all 72 payments of $511.82 (as stated in our contract) but fail to pay their "so-called fees," they will ding our credit each month the fees go unpaid and eventually will repossess the vehicle. It's really leaving us no choice but to pay it.

    This woman is an absolute liar. Deceptively made me believe that I would be able to have my car; connived, schemed, plotted, and being deceptive. I had my car repossessed without warning. I am determined to fight back. If I don't get any justice, I would be glad that I fought for others who couldn't. I've filed a complaint with the Federal Trade Commission and the Dallas Better Business Bureau.

    We must band together to stop companies taking advantage of people with challenged credit, yet all the while ripping them off. They took my car and I'm in the middle of nowhere.     I was making my payments to Ms. Gwen ** every month. She has been accepting my payments per our verbal agreement. I made 2 payments on November 6th, a full payment, then on the 16th, a partial payment per Ms. **. She asked me about my next payment. I told Ms. ** I couldn't do another till the 15th of December. She agreed; she said I would have to make a full payment. I agreed then, agreed on 2 payments in January to defer the payment as she explained to me and we both agreed verbally. I called in on the 15th of December to make my payment, but all I got was her answering machine. Ms. ** gave me her direct line to only deal with her. I kept calling her, kept leaving messages. Ms. ** never returned my calls. On the 16th of December 2009, I woke up to go to work. My 2004 Chevy Trailblazer was gone. I called the police, and they said it was repossessed. I called Santander and told them that I tried to make my payment on the 15th and Ms. ** was not there. They repossessed my car and I had a verbal agreement with Ms. **. I have had my car since Oct. 2007.

    I was told by Gwen that she would work with me. I was one week away, 01/08/10, to catch up my payments. Santander stole $600 from my account and never applied it to my account. I kept asking Gwen to extend two payments. She said I had to remove the "cease and desist" from my account because I complained that I was harassed by Drive/Santander when they called 30 times a day. I want justice served. They took my car in the middle of the night when I just moved to an area where I know no one, and it's less than 30 minutes away from my job. I contacted the local police. The police informed me to contact an attorney. The car's sticker price was $22K. Almost 2 years later, the amount that I owed is $17.5K. Clearly, I have been robbed. Every time, I tried to call, my phone number is blocked, or the dollar amount is a different amount. These people need to be stopped.

    I am going through my company to get legal assistance. I contacted the Dallas Better Business Bureau, and filed a complaint with the Federal Trade Commission. Congress and the News Media is my next stop. I won't rest until I receive justice and resolution. People work too hard for their money to be treated like their money isn't nothing. God sees all! I say we form a class action suit against Santander Consumer USA! See how they would feel.

They call from many different numbers. They have threatened my mother and me. My payoff is not correct; it is twice what I owe and climbing and they won't furnish any paperwork.     Santander Consumer took over an auto loan we had with Sovereign in the spring of 2009. With Sovereign, we had a payment book with coupons. I paid two payments per month because we were trying to get out of debt. With Santander, they sent us a monthly statement. Our first statement was in June 2009. I paid double the amount due. In August and September of 2009, I also paid double the amount due. Then the statements stopped coming in the mail. However, since we were paid three months in advance, I wasn't worried about it. Our next payment would be due in December 2009. We received a statement in December 2009; however, the statement claimed we were overdue on our payments.

    I checked my financial records and discovered that we were paid up to date until December. However, after reading about how Santander was repossessing cars without advance notice, I became nervous and called them to get my final payoff amount on December 12, 2009. I wrote a check for the entire balance we owed them and mailed it that morning. Today, Sunday, December 13, 2009, Santander called us at home to tell us we were late on our payments! I explained that we were not late because we had made double payments in June, July, and August and that we never received any statements from them since then until December, which statement claimed we were overdue.

    I told her that we paid it off in full yesterday because we became nervous they might repossess our truck even though we were up to date on payments. I asked her how long until they would send us the title to our truck. She said it would be about 30 days. We're keeping fingers crossed that they don't come here in the middle of the night and take our truck away! There's nothing like not sending statements for September, October, and November and then waiting until two weeks before Christmas to drop the boom on unsuspecting consumers.

    I purchased my car through Drive Financial and they were already pains to deal with before they became Santander. My husband suffered injuries from a car accident last year and was placed on STD. We got behind on our payments, but Santander always received something even if it wasn't the full payment. In July I was contacted by Santander and told that they would like to defer the two months I was behind to help me get current. This was exciting to my husband and me because we have had our car since January of '07 and didn't want to lose it. The payment due for May was only half of my regular note and the full payment due for June, plus late charges.

    The deferment was granted and two days later, they received a $600 payment from me. This was $200 over my regular payment. In August, we received our statement. The deferment was granted, but the fees were still there along with September's bill being due. We sent a check for the late charges to clear them out so that all we would have due was September's note. The check clearly states that the payment is for late charges only. We paid September's note and added an extra $100 to cut October's note down. We didn't receive another statement until the November payment was due. The late charges were still on the statement along with $155 added to November's note.

    We called and were told that the check for the late charges was applied to October's payment and couldn't be retracted. So the remainder of October's bill was added to November. How can you receive a payment for the exact amount of what the late charges are, ignore the notes written on the check and still say that I owe late charges. I haven't paid November's note until they rectify their mistake. They try to calculate on the phone to tell me that the amount is correct when it is not. Now they are calling me about my payment due, but when I question them about their practices, they become hostile and don't want to work with me. I want to make my payment, but not for what they are saying the amount is.

    I received a call from this company stating I was late on my truck payment that had been with Triad Financial for 3 years. I never received anything notifying me of the sale of my loan to anyone. I advised them I had mailed the payment to Triad as usual and was asked to make another payment over the phone so my account could show up to date; I had mailed the payment 3 days before, and it cleared my account 2 days after this call. The caller was very rude and abrasive when I told her I would not make a payment over the phone, since I did not even know who they were. Now, I have checked to see why I am not getting statements for my payment, and they had an address from over 2 years ago on my account.

    Payoff amount that shows on the truck is also higher than what was owed when I looked into trading the truck in 4 months ago. They have also shown me as late on my credit report when the payments post way before the due date on my bank account. Why is that? I was at one point nearly 3 months ahead on the payments and am shown as late? This just doesn't compute, and calling does no good. You cannot get someone on the phone unless you are in arrears on your payment, and since I am not, I cannot speak to anyone regarding these issues.

    These people are some real jerks. They charge $10.95 for a check over the phone or an online payment! Are you kidding me? How about a class action lawsuit? I never asked for my loan to be bought out and I think this bank should have to abide by the agreement that I originally signed on to, not what they want to change it to. I did not get a letter from these people until 12/05/09 but they have been calling me since 11/10/09. They tell me they bought my note but sent me nothing in writing and they jacked on 68 bucks plus $15 and some change for late charges. Then they tell me if I mail my payment on 12/07/09, I'll be over 30 days. But my payment due date is on the 15th. If the mail can't get from KC to Dallas in 8 days, what's the post office coming to?

    These people are terrible! I fell behind after my father died, and I had spent 7 weeks traveling from MA to NC to be with him. I was making payments; granted they were not full payments, but I was trying. I also had the "special arrangement" messages, and "programs" to work with me were total **. Their idea of arrangements or programs is being able to take your full payment over the phone, plus the $10.95 fee they charge. (And unless you mail your payment, online or phone payments all cost $10.95.) They did end up repossessing my car, without any notice. The repo man came at 1:30 am, hooked my car up, and then knocked on my door, waking up both my kids when the dog started barking. I had made a full payment that afternoon and offered to show him the printout, but he did not care. The service from the repo company (which is a subcontractor of another subcontractor) was completely horrible and another complaint altogether.

    I spent the next day calling them to make the full payment due to have my car released. At first, with my consent, they agreed to deal with my husband over the phone to get it straightened out, but then they changed their mind and I had to call myself. Making calls like that from work are not allowed. I stood outside in the freezing cold talking to Yolanda (the rudest, most ignorant excuse of a human I have ever dealt with) over the phone. After she took the payment, she told me she had to have my boss’s phone number and my employment info and also 2 references to call; that until I provided that and she could actually verify it, she would not send the paperwork to release my car. I was livid. I asked why I should provide references when I am the sole person responsible for my car. She said, "Ma’am, if you ever answered our phone calls, we would not have to do this. Since we cannot reach you, we need to know 2 other people and your boss who can." I told her if they were not so rude, I would answer.

    You can’t have a civil conversation with these people. So why bother (especially when they are calling you on your cell phone at work)? I told her I fulfilled my obligation and fully paid what I owed and that you cannot hold my car hostage because you want phone numbers of family/friends you can harass looking for me. She refused and also told me there was no one else I could speak with. She then asked me to verify my address. I told her they already have it; they came and took the friggin car. Her reply was "Just because that's where we picked the car up does not mean you live there." So I told her my address again, and she asked again, "So this is where you actually live?" I said Yah, and she said, "Ma’am, I need a yes or no." Then, I asked her if she had to verify this information and actually call these people before she released my car, and she said yes. Are you kidding me? I had to hang up with her and call around to see which friends I had who would actually be there to answer their phones.

    When I called back, I got a guy named Robert who told me she was wrong, I did not need to provide and have her call those people in order to release my car, and that the paperwork should have been done right then. I hope to God she ends up in a position to be so financially broken down, that something is taken from her, and she is treated like the ignorant ** she is by someone trying to collect from her. These people are total jerks and treat everyone like they are some sort of criminal. Oh, and to get my car back, they refused to tell me where it was, and then they told me it was in another state. After calling 3 different asset recovery places, I had to meet the guy who took it in a 7-11 parking lot and pay him $150 cash. My car was not in other state. Because they lied about it, where it was, and what time they closed, I had to pay another day for storage fee.

    I am starting to receive phone calls from this Santander company that supposedly purchased Triad Financial. I made arrangements with Triad to pay my car off with an amount of $1200.00. They said as long as I did it on the 31st. Well, when they put it to the fact that I had to use my debit card only, that was the only way they would accept the payoff. I told them I could not do that until the upcoming Friday so that I could get the money into my checking account. I work out of town 60 miles, so I have to schedule things to be handled from my bank when I can be there during banking hours, etc. I spoke to Mya, and she spoke with her manager Tim to assure me that the payoff of $1200.00 would still stand on this date. The only mistake I made was not having this to put into writing. I was unaware that during this time, Triad was selling to Santander. Now, I cannot get in touch with the Triad Financial people that approved all this and Santander is calling me daily saying I still owe $401.00+ and will not release my title.

    In late September, 2009 or early October, 2009, I started receiving phone calls from Santander stating that I was late on my payment. I had made all of my payments to them every month since May of 2007. The payment that they say was missed was the November payment in 2008. Nearly one year later, I started receiving these calls. I tried at first to be civil with the representatives only to be told that I was not making my payments. Feeling threatened as they were marring my grandmother's credit and mine, I became hostile. The bank representatives never wanted to do anything to help out the situation and basically the burden of proof was on me.

    I have been working with my bank to get the proof of payment I made from over a year ago now. Unfortunately, I have had three bank accounts that I have used to make payments to them and also a money order once or twice. It was virtually impossible to speak to a supervisor and the representatives usually hung up on me. This has been going on for almost 3 months now and was not the first time it has happened. I proved them wrong. I also was reported for the first 3 months of my loan as being late and the first 2 of these payments were made to them, right at the car dealership where I purchased my vehicle, on the day of purchase. I also have the problem of when I mail a payment to them, it may take several weeks and on occasion or 2, up to 2 months, for them to receive it.

    This has obviously caused problems to me also with "late payments". I'm not sure who is running this outfit but I am sure that things were not being handled well or professionally and based on the other articles that I have read, I am not the only one having problems with them. I have lost my patience with this company and would do almost anything to have another bank buy out my loan.

    Santander Consumer USA Inc., PO Box 562088, Suite 900-N Dallas, TX 75247, phone #888-222-4227 has now acquired Triad Financial as of 11/09/09. I have been with Triad Financial PO Box 982025 North Richland Hills, TX, 76182-8025 since 2/02/03.

    Our contract states an annual percentage rate of 18.950% with a finance charge of a dollar amount credit cost for me of $13,120.4, amount financed credit provided to me on my behalf $18,901.59 with a total of payments made from me of $32,022 if made on schedule with a total sale price of $32.022. A down payment of $1,500 made on 02/02/03 with 72 installment payments of $444.75 due on 03.05/03.

    A few months later that year, I changed my scheduled payments to be made on the 20th of the month instead of the 5th of the month, which it has remained until this present date. I have fulfilled on 72 scheduled payments with my last 3 payments made on 09/21/09 of $444.75 and $889.50 payment made on 10/02/09. November 13, 2009, my car was repossessed at 5:00 in the morning for the reason of being 116 days late. Not only was I not 116 days late, I paid in October and was not due for another payment until Nov. 20th. When I scheduled these payments to me taken from my account through a Triad rep on 08/11/09, the rep explained to me that my loan had matured and I will have had completed all my 72 contractual payments and the remaining balance of $3,598.11 was due to a couple of payments put at the end of the loan penalties, late fees and interest on the late fees.

    The rep told me to call 714-373-8300 and ask to speak to a manager and ask for a settlement amount to be agreed upon. On 10/09//09, I called and asked to speak to a manager. I was transferred to Ms. **. I explained to her with all the car repairs I have had to make and at one time was laid off and/or working part-time, it caused me to be late at times but through all of this, I have paid all my contractual payments. I would like to propose a settlement amount of $1,400 to be made with one payment of $1,000.00 to be made on 11/20/09 and the final payment of $400.00 on 12/01/09. She said that's not quite half but okay, go ahead and fax me what you have agreed to do to fax #800-462-8619, in which I did. I called and left her a message that it had been faxed.

    November 12, 2009, I received a letter from Santander Consumer USA Inc. Dallas, TX stating they have recently acquired Triad Financial Corp and the transfer does not affect the original terms of my auto loan. I will soon receive a monthly auto loan account statement with instructions for submitting my payment and my statement will include a payment coupon, return envelope and instructions for mailing my payment to Santander consumer USA via regular mail. November 13, 2009, my car was repossessed at 5:00 in the morning. I called the old Triad number of 714-373-8300, pressed #4 for account information and would immediately get a busy signal. After several attempts at this, with the same response, I got the Santander letter out and found their number of 888-222-4227.

    I spoke to ** and explained what had happened with my car. He said the only thing he could do is have the loan remodified and he would wave the $400.00 repossession fee and would put it in the notes for the reinstatement department. I asked for his manager. I spoke to his manager, Ms. **, and explained to her my settlement agreement. She said she saw in her notes that this was so and Ms. ** tried to contact me, but my answering machine was full so since I didn't have anything in writing, I was considered 116 days late. That is why they took the vehicle and she will not honor my agreement. Due to this circumstance of my previous agreement with Ms. **, she will do me a favor, accept the $1,000.00 and remodify the loan instead of asking for $3,683 in full. And I should pay it today instead of 11/20/09 because the longer they hold the vehicle, the more I will owe in storage fees. If I paid it that day, I could get my vehicle back that very day.

    I was then transferred to the reinstatement department and was told by ** that I will not get my car that day even if I made a credit card or Western Union payment. They will not remove the $400.00 repossession fee because that is not how they operate. The payment will have to post on Saturday morning on the 14th and they will fax the remodification papers for me to sign. I would not receive my car until probably Tuesday or Wednesday of the following week and I would be responsible for all the storage charges. I called back to speak to Ms. ** and I was first told she had left for the day. I called back 30 minutes later and asked for Ms. ** again. I was finally transferred to her. I explained to her what Ms. ** had told me. She said perhaps she (herself) was wrong, that she had worked for Triad and the reinstatement department was new, and she didn't know them so perhaps I should call that department back and ask for a manager in their department, in which I did.

    I spoke to Ms. ** again and I asked to speak to her manager. She said her manager was not there. I asked if there is another manger I could speak with. She said, "Yes you can speak to Ms. ** and she will advise you of the same thing I just told you." I spoke to Ms. ** and explained the whole situation again - that I was not 116 days late, have been a long term customer, have completed my payments and have settled on the late fees - could an exception be made to pay the $1,000.00 that day and sign the papers and receive the vehicle back on that day? She said this is not their usual procedure, but she will see what she can do and will call me back. After 2 hours had passed, I called back several times.

    I was told by an ** that he didn't know who she was and I was transferred back to the reinstatement dept. I spoke to an ** and she said Ms. ** was not in her dept, she is in collections and she does not know the collections department's hours, but she will send Ms. ** an email. I called back 30 minutes later and I spoke to **. I told her I heard a fax try to come through, but my fax machine was not on and perhaps Ms. ** had tried to fax my modification papers. She said she doubts it because that's not how they operate and I have called several times, the best I can do is email Ms. ** again and she may have left already. I asked if I could speak to someone else in that department. She said she did not know anyone in that dept nor their hours, but she would leave a message for Ms. **, but more than likely I wouldn't be able to speak to someone until Monday the 16th.

    ** called me back and said Ms. ** told her that she had spoken to the vice president. He said I will not receive my loan papers that day and I will have to wait. I asked what is the VP's name and she exclaimed, "I cant tell you that!" I called Saturday, 11/14/09, and spoke to Ms. **. I told her I want to receive in writing their repossession policy and also to get in writing a statement concerning the answers to my questions regarding monies owed after the sale of the vehicle; and if I pay off the car, would it show a repossession on my credit report. She said I would have to speak to the reinstatement dept, but they were closed. I said, "How can they be closed? Ms. ** said they would not only be open, but that is when she would fax me the remodification loan papers to sign." I asked for her manager. She transferred me to Mrs. **.

    I asked her all of the previous questions I had asked Ms. **. She said as far as the repossession charge, we report to the credit bureau every 30 days. I asked, "What does that mean? Are you saying if I get the car back before 30 days, it will not show on my credit report?" She said, "Probably not." I told her I have spoken to several different people and everybody has either lied or told me different stories and probably is not a definite answer. I need everything in writing to be faxed to me. She said, "I am quite sure everyone you have spoken to has told you we will send nothing to you in writing!" I told her that is illegal and I am voiding my $1,000.00 bank card payment I made with ** yesterday until I receive their repossession policy, my original contract and my payment history so that I may make an informed decision before I make any payment agreements with them because my car was repossessed on false pretenses.

    They were wrong in taking my 2000 Ford vehicle account#** or Triad's original account for me would be my SS #**. I would like my vehicle restored to me less all the repossession charges and my prior settlement agreement honored. Thank you!

    I received a letter from Santander stating it had acquired my account from Triad. I checked my credit report and saw that Santander reported me late in Oct. 2008 and Nov. 2008. I was not late in Oct. 2008 or Nov. 2008 with Triad. I called Santander and was told there was nothing they could do.

    I received a settlement offer for $1,050.00. I contacted the office in order to work out a lower amount since I was unemployed and I had been in a major accident so I don’t have income. On October 16th, I spoke with a male representative who placed me on hold after our initial conversation and stated his supervisor said the lowest he could go on the settlement was $870.00. I then told him that, that was still a bit much and all I had was $650.00 that was given to me by my lawyer but if they would take $750.00 that would be great.

    Their representative placed me on hold and when he returned, the phone disconnected. When I called back another male answered and was obnoxious and rude so I hung up and called back and got a lady on the line who, all but told me she didn't believe what I was telling her and that she would ask the first representative because he sits right across from her. As expected, she came back on the line and said she was informed by that representative that what I said was untrue and all that they weren't willing to negotiate the $1,050.00 after I was initially offered it.

    This could have been easily rectified if they would play back the recording since all calls are recorded and monitored. I would like to pay this company but they can’t get money I don’t have. I didn't want to include this bill in my bankruptcy. I wanted to settle it but all I have is $650.00. If someone from this organization with a professional demeanor can contact me and have the authority to work out a reasonable deal, I would appreciate it. They are threatening to take my car when majority of the fees are late fees and interest not principal amounts.

    My car loan was sold to them by Sovereign Bank. I never received a coupon book or anything from them. I sent my July payment to Sovereign because I didn't know where to send it. The day after the due date, I got a bill from Santander. On July 8, I requested a payoff letter be sent to the Credit Union who I was refinancing the loan with. Santander told me, 3 business days. On July 15, I called back because they had not faxed the payoff. On July 17, I called back because they hadn't faxed the payoff. On July 20, I called back because they had not faxed the payoff. Each time, I spoke to a supervisor. The service has been terrible and, frankly, underhanded. I will call every day until I get my payoff letter. If I hadn't sent the payment to the old bank, I would have been charged a late fee, even though I hadn't been sent a bill or instructions on how to mail my payment to the new bank. If I do not get the payoff letter by Aug. 1, I will not get the lower rate from my Credit Union.

    In April of 2008, I purchased a car. The financing was through Wells Fargo. After making five payments, I refinanced the car through Roadway Loans or so I thought. After preparing all the paperwork for Roadway and sending it in, I thought all was set. Well, it was not just before my first payment was due I received notification that my loan paper had been purchased by Drive Financial. That is where all my problems started. I was being called on monthly basis telling me that they needed information and a week before each payment was due, I would get a call telling me that my payment was due. I gave all the information that was on the original loan application several times and Drive Finical was still not able to record it. My insurance company still has not been listed on my account page.

    In December of 2008, I was laid off from my job. I have managed to keep my payment current. My next payment is due on August 15, 2009. I did foresee a problem so I called them and ask on several occasions for some assistance because I did not want to get behind on my payment. I called the last time on July 13, 2009 and was told that I could not speak to anyone about this problem because until I was behind, they did not consider it a problem. I was also told that the only way someone would talk to me other than a customer service rep is to let me get in arrears. I have done everything I can to talk to this company. No one will even talk to me. I must also state when Drive took over, I did not sign a contract with them. My contract was with Roadway Loans. I was never given the opportunity to even purchase insurance on missed payments due to unemployment. This company continues the threat of only dealing with me if I get behind on a payment. As long as I am current, they will not talk to me.

    I have had my 2006 Buick Lucerne since July 9,2008 I made my 1st payment to Drive Financial 8/15/2008. At that time I set up recurring payment, so my payments would automatically be taken from my checking account each month. I have NEVER missed a payment. Unfortunately, in October 2008 I started receiving collections calls from Drive Financial about me being past due for my 10/15 payment. After discussing my account with the collector they were able to see that even though my account showed past due - in reality I was not - there was something wrong with their system. Well, at that time I was told that someone would look into this and I will get a follow up call. Several weeks went by and I was still getting collection calls and the only thing they would say was there was no way to stop the calls. I talk to several reps and everytime I would ask for a supervisor, the representative would either pass the phone to their co-worker to do a talk off, transfer me to some other dept. My account went 35 days past due before I was finally able to speak with a supervisor and I was promised a callback and that this would be resolved.
