I originally financed my vehicle in 2007 with CitiFinancial. When Santander took over the loan, I kept receiving phone calls that they had not received my payment, yet I had mailed my payment. This happened for about 6 months. I once again had to cancel those checks every month, resulting in fees with my bank. My maturity loan date is May 2013. Therefore, I should owe approximately $4,300. However, when I contacted Santander for a payoff, I was given $13,950 as a payoff. I repeatedly questioned why I owe more than my payments and I was not given an answer. I even tried to do live chat and when I questioned the amount, the representative ended the chat.
I called again and was told it was late payments, which is ridiculous that I would have fees in the amount of $9,000. I was not able to obtain a printout and was told to go to website. However, the website only goes back one year in history and it makes no sense. Is there still a class action going on? If not, I have no problem going forward with my own lawsuit. Businesses should not be able to do this.

My husband lost his job and we have been making every effort to catch up on the bill. On 10/26/2012, we were over 30 days delinquent. The rep advised once we made the payment, we will be less than 30. She was gracious enough to get the fee waived. Once waived, the payment was made and she offered a due date change. We were leery but took the offer. The recording was done to change the due date and we knew we still owed for October. November would be due on the 25th. Well, little did we know nothing happened and after speaking to four different people (different answer every time) no one could advise the reason why the due date change was recorded but yet did not happen. The reps are exhausting and not knowledgeable at all. It shows they only work for commission, not for the benefit of no one but their paycheck. The best advice is, don't attempt to take offers of due date changes. You will be more upset than ever.

I bought a vehicle through CitiFinancial in 2006 that was sold to Santander in 2010. My contract was for 72 months which was due to be paid in September 2012, but like so many others, I had a few hiccups. So after making 64 payments, they are stating that I still owe over $16,000.00 on my loan. I only found this out when we went to trade the vehicle in. They sent a printout stating how my payments were applied - with some of the payments not reflecting what was paid.

I had a loan with Santander and I thank God that I put down $8,500 on my vehicle, so recently I was able to sell it to a dealer and received my payoff plus a little extra for my pockets. Now I realize not everyone may be in a position to do as I did. This company is very disgusting. After making 8 on-time payments to this company and owing more than what I financed and having their customer services reps try to justify it with some logic as if I were an idiot, I knew I had to get rid of the vehicle. I did 2 days later. This company is no more than a ripoff to desperate people needing a vehicle and having challenged credit. Some people have also had accounts sold from other banks.
It is amazing that the United States allows this business to conduct business in the manner that they do, but I am sure it is something in it for them (United States government) as well, but that's another story for another day. My suggestion would simply be to just give them back the vehicle, cut your losses and be done with the headache. Sure in another year, you could finance another vehicle with a repossession. This bank is awful and most banks around know that. They are loan sharks and cons. Buy a car cash, if possible. Anything is better than dealing with this bank and having all your money be eaten up in interest and other irrelevant fees. I believe if people started giving them the vehicles back, they couldn't make the money and would lose money. They may start approaching things a little differently. Just my 2 cents.

It's exhausting trying to get anything done with this company. My loan was sold to Santanders from CitiFinancial. I was fine with paying my $450 car payment and everything was just fine. The problem happened when I totaled my car. Santander decided to double payments on me. I tried to work with them and explain that I can't afford to pay $900 a month due to being a single father. It was call, after call, after call in trying to communicate with them that I want to pay my normal car payment because I can't afford $900 a month payment. No one would help me and basically said they cannot help. I continued to pay the same amount. Interest, late payments started to eat up any effort to pay. This has been frustrating and I am at a loss on how to work with a company that just doesn't really care. Why are they doing this to consumers that are really trying to be responsible and just pay what was originally agreed?

Santander has contacted me after and before legal calling times. I work on a graveyard shift and have had my sleep interrupted on an almost daily basis. Also, somehow, they have contacted friends of mine who are not listed as references and are not part of my loan in anyway whatsoever. The practices of Santander Consumer USA are outrageous. How do they get away with what they do?

When is someone going to finally do something about Santander USA? Like all the other complaints that I have read, my story is the same. Santander USA took over two car loans, one from CitiFinancial and one from HSBC in or around October 2010. Like most consumers who fall on hard times, making payments became difficult. We called Santander and they had zero interest in helping out, even putting payments to the end of the loan. This month, both of my vehicles were repossessed - one on October 2nd and one October 18th. This company is so shady with the way they do business and yet no one will do anything about helping out the consumers who are getting screwed by a company that is out to rob the consumer. We called to see if we could maybe get the vehicle that was taken on October 18, 2012, only to find out that they already sent it to auction. They had only had it for 4 days. How can they not even give you an opportunity to get it back? That's just not right! I want to sue this company, but who can help me?!

My auto loan was sold to Santander Consumer USA from CitiFinancial in 2010 and the nightmare began. My loan was due to be paid off on September 30, 2012 but due to several financial problems, it is now due to be paid off in March 2013 which they agreed to but they are saying that we still owe over $16,000 on the loan that was only for 72 months. We called today to get an explanation because we found the contract with the initiate outline. No one could explain the tacked on money that they are reporting is still owed on the loan. My husband was going to trade the car in but couldn't once they lied about what is still owed on the vehicle.

My loan amount from this company is $20,500 and I paid more than $5,000 in the past 12 months. My balance is $19,500. My advice to people like me is never to get a loan from this company.

I was supposed to finish paying my car loan in October 11, 2012. When I went online to check my balance, it was showing me $600.00 more. When I called them, they told me it was because of late fee interest. They told me that I was late 8 times. I told them, “* times in ^ years and you're charging me $600.00?” The best thing he could say was that he was going to remove one of the late fees ($19.79). Wow. The next week, I went online to make another payment so I could get this done and over with, but the online site payment was down and I couldn't make a payment. So, I called them and they want to charge me $15.00 to make the payment by phone. I told them that I usually pay $5.00 to make the payment online. They told me that it was nothing … they couldn't do anything. I told him that it was not my fault that the system was not working, and he still told me that he couldn't do anything. All I can say is this company is full of crap.

What happened is my car loan was given to another bank without my knowledge nor was I notified of the change in banks. I purchased the car in May of 2006. The bank I had then was HSBC Bank. They turned my car loan over to a company called Santander USA. For two years, I was still sending my payments to HSBC Bank without knowing about the change. Now they are trying to make me pay late charges fee which is over 2,000 dollars because the original bank who I was still sending the money to was sending my payments to them late. They tried to tell me that they tried to contact me which is not true. They also told me that they were sending my mail upstate NY. I can't see that because my zip code is not an upstate zip code so there is no way they can say that. Also, my job number is also on the loan form along with cellphone number. I tried to explain to the company that I was never notified about the change in banks. If I did, then why would I continue to send my payments by money orders through the mail for 2 years straight? How I found out about the change was a phone call I got from a friend.

Can someone please help me? I need help and I have no clue what to do. Santander is so hard to deal with and can’t explain certain fees nor send me documentation of a break down on how they are charging me the outrageous miscellaneous fees. I had Santander mail me a statement showing the payment history on my account and none of it makes any sense.
The auto loan was originally through HSBC in September 2007 and in 2010 was then taken over by Santander. On the statement history of the loan, there are 5 separate columns: Amount paid, Principal, Interest, Late Fees, and Misc. Fees. My concern is in the column that states amount paid shows that amount going in the miscellaneous fees column and not applied towards interest or principal, and then when you go down the statement to another amount paid, that payment shows applied toward interest and nothing in the miscellaneous column.
These payments are all over the place on this statement. None of the misc. fees are the same they range from $181.62, $86.48, $5.81, $150.00, $132.00, $370.00, $91.86, $15.00, and $6.40. If a miscellaneous fee can’t be explained, I don’t feel I should have to pay it. That’s like getting a random letter in the mail that just say’s miscellaneous fee, or going to get your hair done by a stylist and when she hands you over the itemized services she provided for you and you see misc. fee, you’re going to want an explanation or you’re not going to pay it.
The auto loan start amount was for $27,989.70 for 72 months. The payments made to them add up to $27,883.07 as of today; I’m told the payoff amount is $21,177.44. I really feel like I’m being taken advantage of. They have horrible communication skills at Santander and they never read previous account notes before they call you. They tell you one thing and then when you call back, you get stuck with speaking to someone different that tells you completely different information on the same question you asked the previous person you spoke to. Santander is by far the most unorganized company I’ve ever dealt with, horrible customer service, lack of knowledge, and should be shut down and put out of business.

My auto loan was sent to Santander USA after HSBC closed their auto financing company. I have paid Santander USA $8400 since July of 2010 and found out yesterday while trying to purchase a new car that they haven't applied the payments to my accounts! I gave up years ago trying to gain access to my account online and receive statements from them. My plan was to contact them in December for my pay off amount and finally finish this loan until I decided to purchase a new vehicle this past week. My story is long and involved, but I am so tired of the ** this company is spewing. I have contacted my attorney in Texas and will be filing a formal complaint with the Texas attorney general's office. Do not do business with this company! If you are in my position and your loan was sold to them from another company, do what you can to find and refinance with someone else.
After reading how many complaints have been filed against this company, I'm truly amazed they are still in business. No matter what the circumstances, I have been advised they are in quite a bit of legal trouble taking my money and not applying it to my loan. They have my new address when I moved from Texas to another state. I've received one piece of mail from them, so when they tried to use that excuse of course it didn't fly. I'm letting the powers that be deal with them now. It is my understanding that the Texas attorney general's office has multiple complaints against them. They can add mine to the stack now.

I paid my car off 4/12 and never received the title. I have a new baby and was shopping for a new car that would provide more safety than my current car. I cannot purchase the new car that I want because I don't have the title to my car; my property, no title. They have the correct address and I seem to receive all my other mail. Where is my title? Now, I have to submit for a lien satisfaction letter which I will need to use to request a duplicate title. I've been told I will not receive the duplicate title from the state of CT for 150 days! Thanks to Santander, I will need to continue driving a car I bought prior to having my child, one I would never have chosen had I known I was going to have a child! Thanks Santander! I love the inconvenience! And I love that you feel you need to charge me for the lien satisfaction when this is your mistake, not mine.

No reply on pay off amount - There is no answer on telephone calls. I've been paying this bill of $256.25 through ChargeSmart for Santander account per month. ChargeSmart has no record on the balance. I feel I'm getting ripped off. What do I do?

HSBC Auto was sold to Santander USA. Our loan was originally with HSBC Auto, maturity date 5/24/2012. Because of two deferments, it pushed our maturity date to 7/24/2012, no problem for us. As of 7/2012, we sent Santander, USA $1000 final payment only to find that they have since tacked on $1683.49 for what, we do not know. In an attempt to reach them several times, we were pushed from one rep. to another, all of whom were rude, unprofessional and harsh, to say the least. However, we were most impressed with Mr. Eric ** who claimed to be the president of what, we are unsure of. And of course there is Mr. ** who also called us and spoke to us as if we owed this outstanding debt that he nor the president could explain to us what this was for. So, as of this morning, 9-5-2012, we have now come to find out that this debt has increased another $500 or so bringing this debt to $2111 for what, again, we do not know. The maturity of this loan was paid off in July 2012. This company is a big rip off and we never had this problem with HSBC Auto to whom we've paid off one car through already.

On April 21, 2012, I was granted a settlement offer on my vehicle by a Ms. **. The confirmation of PIF and that title will be sent to me in 4 - 6 weeks. I have called them on the 6th week and every other week since. It is now 08/20/2012 and I have yet to receive my clear title. Other reps I have talked to are Rod, Kenny, Mr. **, Alitisha, Pete, Dawn, etc. How do I go about receiving my actual title? As of 2 weeks ago, I called and can no longer talk to a person. The automation machine wouldn't allow this since my vehicle is PIF, I cannot get into the voice mail system.

My account was paid off almost a year ago, but I never received the title or proof of lien satisfaction from Santander USA. According to The Department of Motor Vehicles, the company that originally held the loan, HSBC, still had a lien on the title. A call to HSBC directed me to the title department of Santander. Because my account was no longer in their database, I could not get past the automated system. Long story short, via Google, I discovered that the paid up accounts are handled by a 'partner', Title My Way, who processes lien satisfaction letters for either $30.00 or for $60.00 for next day expedited delivery. What crooks!

In September 2005, I bought a van with Citi Auto. They in turn sold it to Santander. It was originally for $23,000 for six years with a payoff date of September 2011. At that time, they made me sign a new contract, because I still owed over $11,000 at the time of maturation. I did defer six payments and figured it may be an extra year with the late fees. But it will be two more years for a total of eight years and with no guarantee that it will be paid off. Then, that's even if "I make payments on time." According to the new contract, that's what it said and it also had a disclaimer that I would not participate in a class action. I had no choice but to sign this new contract, because my van is still upside down and I can't get financed elsewhere and they would repossess my van if I didn't sign it. I am extremely frustrated with this "simple interest." It seems to me like it should be illegal for a vehicle loan. This is similar to what credit cards do for "revolving accounts." It takes the consumer forever to pay it off. There should be laws against this.

I have purchased a car through HSBC in 2006. Due to the economy, I lost my job in 2008. I am a single mother trying to make ends meet. I had asked Santander to stop calling my cell phone. They were calling every 15 minutes. I had lost the cell phone and was forced to move out of my home. I have not had any contact with them at all. I just made the payments as much as I can. I was usually behind during those times. When I didn't contact them, they were calling my relatives. I came home on Friday, July 20th and my car was being towed away. When I called Santander, they told me I have to pay $1,936 to get my car back. The payment I owe is $1,500, but $400 for the tow truck company? I have also asked what is the remainder on my loan. She said I owe $11,416 left on the car, 19 payments left. However, when I made the calculations, it is a total of 28 payments.
I have moved two payments to the back of my loan, but I have been paying on the car for six years now. When I looked at an old statement from 7/31/2010, my balance was $14,912 and I already had 4 years of payments invested. I brought this up to Santander, they told me it was going to the principal. Meanwhile, I have to come up with $1,936 to get my car back in 10 days or they will put it up for auction. I am struggling just to put food on the table. I was looking forward to paying it off and give the car to my daughter. Santander claims that I am behind for 120 days. I just paid the car last month. I need help. So many complaints from this company, what can I do? I am at my wit's end with this company. We all need help. When does a consumer get help and when does it stop?

My starting balance was $17,000 and after 6 years the balance is $12,000. My payoff due date is 03-30-13. All payments have been going to the interest and never to the principal. I made a payment arrangement and then made two payments, but they said I was still behind and they can repo the truck as I was behind and there are also late fees. This is the worst finance company I know. My credit is not perfect, but the fees are ridiculous.

This company has been a nightmare since the beginning. The loan agreement was very misleading. I filled out all the paperwork Santander advised me to do and got the paperwork notarized in order to finance with their company. First issue was the car loan amount. My previous car loan company Lendmark told me my payoff was $10,898.00, but Santander/RoadLoans said I financed $11,320.00. I didn't apply for that amount. A refinance analyst named Joanna emailed me on 1/17/12 about the mileage on my 2006 Cadillac CTS. She wanted to know the exact mileage. I emailed her back with the info the same day.
On 1/20/12, I received an email advising that she finished my loan. Next on 1/27/12, I spoke with a rep who called me about confirming my loan. She advised me my loan was $300.86 a month and it's $11,320.00 for a 60-month term. I received paperwork in the mail the same day telling me exactly what she mentioned over the phone. I never agreed or signed up for that. I agreed to $269.73 a month for 72 months. So, I explained that it was incorrect and that is not what I signed or agreed. The rep wanted to investigate and get back to me. She never called me back. So, I emailed Joanna again for assistance on 1/27/12. She replied on 1/30/12: "Tiffany, I apologize. Due to the mileage on your vehicle, you didn't qualify for the 72-month term. Therefore, your loan term is 60 months for $300.86. When you applied, you didn't put any mileage in and the system allowed you 72 months."
I felt she was not telling me the truth. So, I just no longer communicated with her any longer and decided to call customer service. I asked for copies of what was submitted and their version of my contract. I also informed the rep that I applied in 11/2011 and I didn't accept the offer, so it expired in 30 days. So I had to reapply again, because I didn't accept the 1st offer. And I think they have 2 different loan/quotes and they are getting them mixed up, because one rep told me I have 2 different loan requests with the same number but one has the letter "R." Nevertheless, I've seen the contract copy from the company via mail, and I can barely read it. Therefore, I was stuck in an agreement with something I was totally misled about regarding the loan.
I was told that if the mileage changed by 10%, I would be automatically changed into a different agreement and didn't require a signature. Unbelievable! So, I left that alone and dealt with the shorter loan agreement and $31.00 difference monthly. The rep who sent the copies even told me that I would pay less interest, so this loan agreement is better. So, I just let it go! I felt helpless.
In April, I signed up for freecreditscore.com and reports to find out if I am making progress with my credit scores. I found out that Santander USA has not reported my car payments to Experian, Equifax, or TransUnion. My 1st payment was on 2/19/12. So, I contacted their credit reporting department on 4/27/12 and spoke with a Virginia. She verified what I said and mentioned that only Equifax doesn't show me being reported and if they weren't reporting my loan, then chances were none of the bureau was reporting. I advised her again that nobody was showing my car payments. She said she needed to investigate this and this takes 2 weeks. I decided to call 6 days later to see how everything was going, and I spoke with a Monica. She told me Virginia was taking care of this and she would contact me when this was completed. I asked how this could happen, and she replied they didn't know and we had to wait until the investigation was over. So, I waited a little longer.
On May 15, I called and spoke with a rep named Altheia (not sure if it is spelled correct) who seemed to be the only rep who was helpful and took the time to explain a few things to me. I asked her why hasn't 1 person called me back to follow up with me. And she told me that I asked for a cease and desist request to be placed on the account. She told me to contact customer service to have this removed. But I would never ask for a cease and desist request, especially since I am having issues with this company! That was never requested. So she put the request through for me and forward to her manager Mary because it was not done yet (Apparently, Virginia never did handle this properly.). So, Altheia told me it would take approximately 30-45 days instead of the 2 weeks I was originally told by Virginia.
Also, I spoke with a man named Tut on 6/27/12 for 10 minutes. He was not understanding and unhelpful. I told him my experience with this company and that I was not personally taking anything out on him but nobody was helping me and I had been patient. He told me that by law, the credit bureaus have 45 days to resolve an issue. And I explained that I started this process in 4/2012. He said Virginia did the process the old way and didn't know to handle this the new way. I said to him that basically she did nothing to help. He said that I was wrong and she did help and she just did it incorrectly and under an old way. So, I said that he showed no empathy for my situation. He told me that my car loan had very little to do with my credit score and that it wouldn't impact my score that much.
I explained to him that was not true and when I am applying for a home, I have nothing to show that I have an installment loan and that I can handle responsibility. So, it appears that I have no loans on my credit report active. I was shocked that he said this to me. I asked for his name and confirmed if Mary was his manager also. He said she was and his name was Tut. I said thanks and disconnected our call.
Now, I am 45 days after 5/15/12, and it is 6/29/12 and still, nothing has been updated on my credit report. I checked with all reports and signed up for alerts with Myfico.com to get alerted for any change. So, nothing has been resolved. I don't know what else to do with this company. At first, I wanted this to be fixed. But now, I am thinking these people don't care at all. Can they get away with this? They advertise that they report to the credit bureaus. They have not held up their end at all in this deal. I am completely unsatisfied, and I would like action. I have tried reaching out via email on their company website. Nothing was heard! Anything you can do to help would be appreciated. Thank you.

Missing payments and harassment. I had $14,704.05 in ACH drafts taken from my account and paid to my auto loan but were never applied. I have numerous problems and have enough proof, but they won’t correct my account.

I took out a loan on a car with Sovereign Bank that was bought out by Santander USA. My household went from two incomes to just one recently and while we are struggling to make ends meet, we have tried to defer our car payments. We have Ford Credit and Santander Consumer USA. We deferred the Ford Credit payment with one phone call that took about 10 minutes and the deferred our payments for 3 months and it only cost us $15. Thank you, Ford Credit.
So once the 3 months was up, we tried to defer our payment with Santander. The first call was done on 5/27/12 in which we were denied. The second attempt was made on 6/18/12 and that was denied as well. Santander denied us because they want at least a partial payment; they did not take into account that for more than 6 months, we paid our monthly payment one month in advance or that we have had no late payments, until now that is, and because they said they would not do a deferment request until we were actually late on a payment.
So this is where I'm very confused. Here is a customer that is trying to keep their good standing with the company and we are told that first we need to be late to defer a payment and then get denied twice and now we cannot apply anymore. The customer service representative tells me to call my mortgage company and get that payment deferred so that I can make my vehicle payment with Santander and then they can change my due date up to 29 days so that will buy me some time. Does anyone see something wrong with this other than me?!

My auto loan is due to be paid off in August 2012. Santander is saying we owe over $2,500 more than what the contract states. I was told by a representative that since it's a simple interest loan, that it was due to additional interest that had accrued. My husband got on the phone and then she said it had to do with the fact that we had deferred 3 payments on the loan. A loan specialist at a car dealer looked at the contract and said it doesn't make sense that they are doing this. We were trying to trade our van in to get something else and the buyout, per Santander is over $4,000 and the contract is up in August of this year. Please help.

My 2007 450GL was repossessed after it was paid off. I was contacted by Santander 3 months after I received notification that my vehicle was paid off. In my ignorance I thought that I must have made a mistake, and so continued to make payments for another 10 months. Interestingly enough, I heard nothing from them for almost a year when I started receiving phone calls harassing me at work, on my cell phone, and my home 7 or 8 times a day telling me that I still owed 3 years’ worth of payments. Who in the hell are these people!? The repo "men" illegally came on my property and threatened to send the sheriff out and put me in jail if I didn't let them have my car.
I ordered them off my property, called the sheriff, and explained the situation. He made me aware of the fact that: 1.) this is a civil suit so therefore they would have nothing to do with it; and 2.) they trespassed illegally. This particular repo company ("OneRecovery", based in Prescott, AZ, 928-772-6345) went to the health food store where two of my sons work, humiliated them in front of their boss and peers and demanded they give up the keys, and took the car away from them. I have since sent for my bank drafts proving they are thieves, and notified the repo company that they too will be sued as an accomplice to the crime. I have attempted to contact Santander multiple times to return my vehicle. I was told today by the repo "men" that my car was turned over to Santander and sold.

I received a correspondence in response to a lawsuit and judgment against Santander for unlawful practices approximately three months ago. Santander repossessed and sold my vehicle for (Santander claims) $540 over the balance due on account and per the findings of the lawsuit, is responsible for reimbursing me the $540 overage. To date, I have not received payment. After receiving overpayments towards my account, originally with HSBC, Santander employees claimed that a $1,400 payment (sent via Moneygram to Santander) was not received by Santander but by HSBC (I have proof otherwise). If the overage payments are not received by July 15, I will contact the attorneys responsible for the class action suit against Santander to request assistance in recovering monies due to me for the illegal practices by Santander.

I took out a loan on a car with Sovereign Bank that was bought out by Santander USA. The notification letter specifically stated that no change in payment information was needed. Santander received and recorded three years worth of payments without issue. Then in December 2011 a payment disappeared. I contacted Santander and was initially told that "I" would have to contact my bank and Santander with all of the needed information. I refused and was turned over to the complaint department who contacted my bank directly. At that time, Santander said they would contact me again to provide an explanation of the issue when it was resolved. A week later the payment "magically" appeared 2.5 weeks after being sent, but no follow-up was made by Santander to explain the issue.
Here it is six months later and the final payment on this car has been sent and yet again Santander has lost the payment. I contacted customer service knowing the first line of idiots on their end would refuse to help. I was told that the complaint department was too busy (no wonder) to speak with me, but someone would contact me.
Last night I received a call from Santander and called them back this morning. The "customer service" rep on the phone refused to contact my bank and told me that I would have to be responsible for documenting the issue. I referred him to the December incident and explained that I didn't have the time to document their lost check. He then asked for the check number as issued by my bank and proceeded to tell me that it was wasn't a valid number and contained too many digits (the check number came right off my bank’s website). I disagreed with him and explained that it was a bank check and not a personal check, at which point he became belligerent and refused to be of any further assistance telling me that providing the needed documentation was my problem. I've since contacted my bank and the original bank issuing the loan; other than a stop payment which Santander will assuredly charge me for, there is no answer but to wait and see if the check makes it through their system.
If you need a car loan, do not use Santander USA. There are currently at least five class-action suits against them in this country for fraudulent charges, improper customer contact, etc. They have no customer service and prefer to make their issues the customers while having the ability to pile on more interest, late charges and fees, and all the while we the consumers take it in the shorts. Given a choice on my next car loan, I'd rather walk than accept a dime from Santander. I've never encountered a more useless and antagonistic customer service department in my life. I hope the Spanish banking system fails under its euro debt problems and causes Santander USA to collapse along with it.

Another victim here. I bought a car in 2008 and financed with Citi. With just over a year to go, this company took over my account. I neither signed anything with them nor have I seen anything. It was financed for 48 payments. I have made them all and still have a $1400+ balance. I got a notice today that I have two weeks to pay it in full or they are coming to get the car. I have joined the class action suit of which you can google and find their site to join. I've already signed and mailed in my contract with the lawyer who is going to work with this suit. The phone calls and fees aren't legal. The lawyer told me as long as I didn't sign a modification, then they had to go by my original contract. I asked for a full account reconciliation as well as a copy of my original contract. That was two weeks ago and of course, they haven't complied.

This company, Santander Consumer Headquarters in Dallas, but the main office is Mexico City is definitely worth investigating. They are involved with fraudulent banking practices, violations of the Fair Credit Reporting Act, numerous violations of state laws including harassment and threats. The following links contain thousands of complaints and they all read with similar context and complaints of regarding corporate behavior. I'm certain the "customer service reps" are scripted.
I can tell you I have experienced their harassment and illegal deceptive practices for the past two years. In September 2005, I purchased a truck and financed it with CitiFinancial for 5 years I made payments of $800/ month on a note that was $773 with the overage to be against the principle. The loan was to mature 9/2011.
In March of 2010, Citi sold my loan to Santander. Citibank had my home address and home phone number and sent me monthly statements roughly 14 days before the payment was due. In between purchasing the vehicle and 2010, I had moved several times and went to carrying a cell phone only. In June 2010, I received a call from Santander telling me I was 4 payments in arrears and owed them $2,500 for administrative fees related to the sale of my loan. Bear in mind I had never received a notice of the sale/purchase by either party. I began receiving 10-20 calls a day, 7 days a week between 6 am and 10 pm from various Dallas exchange numbers, 800 numbers and blocked caller ID numbers. I had been threatened to either pay the administrative fees or my truck would be repossessed.
Frustrated with receiving no help from civil agencies, I paid the money. The phone calls didn't stop. They would begin calling for payment 3 days before the due date, harassing me for a credit card number or check by phone. I had to change my cell number. It started again, how they got my number, I don't know. This went on through the summer of 2011. When I contacted them in September for payoff and title, I was informed that they had changed my payoff date to Jan 2012! In November I had received 3 letters from Santander, all with the same banner headline "Congratulations you’re almost there. You are so close to paying off your loan. You owe $1,642.08 that we will do a loan modification for you to complete the payments." The second letter with the same heading had a different amount it was $3,894.88. The third with the same header had an amount of $6,888.47. I had contacted them regarding the letters and they claimed they were sent out in error.
I continued making payments and in January 2012, I sent what I thought was my final payment. By February, I had not received my title so I sent another payment and contacted them about the title. I was told it was in processing and was hung up on. March, no title, so another payment went out and another phone call regarding the title it’s on processing and hung up on again. Now, we are talking about 78 payments on a 72 month note.
On May 21, I was at work I was making flight arrangements for a Chicago trip and my truck was gone. I immediately called the bank and asked where my title was and where my truck was. They would not tell me the location of my truck until I paid them an additional $3,553.64. The rep said my pay off was moved to 9/2012 and then said but we changed it back to January 2012. The rep told me I was 142 days late!
I wired the money and when I met the repo man to get the truck, he showed me and gave me a copy of the bank papers to him saying I owed $3,021 that was 142 days late. The way I see it, they have stolen $9,400 and change from me and I still don't have the title and I don't know if they will send it either. Read the complaints below and see how many didn't get their titles. See how many people were in the last 90 days of a contract and had their vehicle repossessed and how additional pay off amounts were added. It is disgusting that this practice is allowed to go on in the USA in 2012.

For the last 6 months, I have written on my checks in the memo and called in every month to request my additional payment to be added to the principal balance and they refused to do it. They take it off my interest, but not lowering the principal balance. Every month, it is an argument and I am angry and feel this is illegal. There must be some way they have to accept additional dollars to be put towards the principal balance when requested. My principal balance needs to be lowered when I send in extra money!

I got a car for my daughter with Drive Finance. Santander got the loan from them, and now that I'm almost done paying for it (2 months left) with anniversary date 6/25/2012, 1 payment was deferred with Drive Finance. Santander sent me a statement for $2,700.80. This means I have 2 payments of $385.10 and should be paid off in July. How can they charge me so much extra. 6 years of payments, and now, they expect me to pay at least 7 more months. I need advice on what to do next. I can't pay this. I'm not working anymore, because I fell and twisted my hip. Please advise!

I first got the loan for my Dodge truck with Drive Fin. They then gave my loan contract to Santander. My health got bad and I had to quit work so I called Santander and asked if I could re-modify my loan. They said yes, so I did all they told me to do in a timely manner as per Santander. They told me my loan was modified and my payment would be less so I made the payments for 3 months. Then they said I was in arrears and that the modification did not go through, but they would modify the loan if I got caught up so I gave them $3,000. They said I was in arrears. This I was told and went through again. My payment was reduced, but I would have to pay the original amount before the first re-modification, which I had to or they would repossess my truck.
Again, they said the re-modification didn't go through after 3 months. They told me I was in arrears again and if I catch, they would re-modify my loan. I have paid on this truck for over 5 years and still owe almost the same as the original loan. They have harassed me on my cell phone and called me at all hours. They have ruined my credit, I have had to get small loans to get caught each time they said I was in arrears and according to them, I am still in arrears and I have a witness to each allegation. Please help me, I am not a deadbeat but they treat me like one.

Trade-in payoffs apparently don't apply. On February 19, 2011, I purchased a 2004 Saturn L-300 from a used car dealership in Joppa, Maryland. The only company I could get a loan through was Santander Consumer USA (SCUSA), a 36-month loan with interest rates near 25%. I set up my payment plan through their website for automatically deducting my payment on the first of every month, starting on April 1, 2011.
On April 27, 2012, after multiple repairs to the vehicle in question, I traded it in for a newer vehicle. The dealership received a payoff amount for the SCUSA loan, and sent that amount to SCUSA to pay off the loan on the Saturn being traded in. I also overnight-mailed a letter to SCUSA that same afternoon requesting that they cease their automatic collections, per their regulations and guidelines listed on their website.
On April 30, I was notified by auto-reply e-mail that SCUSA would be taking a scheduled payment from my account, despite the trade-in and overnight letter sent. I placed a stop payment on this and all future automated payments to SCUSA, as the vehicle was no longer in my possession and the payoff had been sent. On May 1, I received another e-mail stating that the scheduled payment had been taken from my account. This was also an automated-reply e-mail.
On May 4, I was contacted by a customer representative from SCUSA, whose name I was unable to get due to heavily accented English, demanding a payment to the account. I explained calmly that the vehicle was traded in, a payoff amount was sent to their company, and that I no longer had possession of the vehicle. I gave all the information I was asked (who I traded the vehicle to, when I did, etc.). I was told that a note on m account would be made noting this information.
On May 11 (the day this is being written), I received another call from SCUSA, and again could not get a name due to the accented English and the fact that the woman who called would not repeat her name, instead continually asking me for a credit card number to make a payment. I had to explain the situation three times before she finally relented and ended the call. I then called the dealership I traded the vehicle to and was told that the payoff had been sent to SCUSA earlier in the week.
From this point, I will be attempting to record all future calls from SCUSA for use in any class-action or stand-alone lawsuits that may come about. They haven't started calling other references yet, but I'm sure that's just a matter of time.

This company is the worst. They repo'ed my vehicle after my lawyer and I asked for validation of such debt. They added thousands of unexplained dollars on the balance close to maturity date purposely to suck you dry of blood. I now have a lawsuit against them and advise everyone to do just as I did. If your loan was originally with HSBC, Citi, etc. and was purchased by Santander, look up how it was purchased. The "Sale and Servicing Agreement" will tell it all. How you get this is by going to the Security Exchange Commission website, sec.gov, and do a company search (HSBC, Citi, etc., whoever was the originator or original creditor of your loan). Look for Form 8K and Form 10Q. When requesting these forms, make sure it's within the time, month and year they purchased your loan.
Once you retrieve those documents, make a copy of both forms, 8K and 10Q, then go to the bottom of sec.gov page and click on: contact, electronic mailboxes, certified documents request, click on the certified@sec.gov, make sure you put the original creditor name in the subject line (HSBC, Citi, etc.) Then request your documents (sample). This sample could be used and is valid for those whom loans were purchased in this time frame: "My name is John Doe and I'm requesting certified copies between HSBC and Santander of the following forms: HSBC Finance Corporation - Form 8K - Date or report: August 27, 2010; HSBC Finance Corporation - Form 10Q - Quarterly Report period ended June 30, 2010."
Form 8K will prove in your favor in court that they are not the original owners as they will claim in court. This information will prove that the loans were transferred and assigned and are in many of the different violations under the FDCPA, TCPA, FCRP, FCC, etc. Form 10Q will prove that the original/originator of your loan are still profiting from the receivables they sold to Santander. It would be listed as either: 1) Sales and Servicing Agreement, Sale of Auto Finance Servicing Operations and Auto Finance Receivables; 2) Transactions with Santander; 3) Subsequent Event; or 4) Receivables. Trust me. This will definitely help you in court and prove Santander wrong. Good luck and God bless.

In May 2006, I bought a new Toyota Yaris, which I initially financed through Southeastern Toyota. Later, I refinanced through HSBC as I had bought a house and wanted to lower my payments a bit. HSBC quit doing auto loans (I don't recall how long ago this was) and sold all (I guess) of theirs to Santander. Never again will I finance anything with these people. I've kept up my payments, though they were late a few times and I have paid all late fees according to their website. I have also, the last several payments, paid more than the amount due with a note to apply overpayment to principal. It will be (I hope, after reading some of the horror stories here) paid off with the Feb 2013 payment. But I'd sure as hell like to know how, if my payments are $319 per month, my account balance can be $3,734.06 with just 10 payments left and the payoff is more than that, at $3,767.85!
I called them once asking about the payoff/balance discrepancy and got some crap about the way they calculate the interest. There is absolutely zero incentive to pay anything off early with these people. If anyone decides to file a class action lawsuit against them, I'm in. And their website, every single time I go on there, it tells me my email address is either missing or invalid, but it is there - correct - in their email field. The only thing is their site lists it all in capital letters and the OM from the .com is outside the right side of the field. But if I put the cursor there and hit the end button, everything's there and correct. Even if I re-input my email address in all small letters, where it will fit visibly in the field, their system always converts it to all capital letters. And since I'm working nights at the moment, if I try to fix it and hit the save button, most of the time I get a message saying changes can't be made between the hours of 10PM and 3AM CST so it won't move forward. Since I'm in the eastern timezone, I have to get in either before 11 or after 4.

I purchased a Dodge Van in 2008. When I bought the van, it was through Capitol One Finance. Then a year later, they sold it to someone else but before that happened, I had renegotiated my loan to make my payments lower. Then in 2008, Santander bought the loan and it has been a nightmare since. I am so stressed about this company and how they handle customers that I actually am sick all the time and I am losing my hair from the stress.
My new loan went from $551 to $331. When Santander got the loan, they did not give them the correct loan documents. They gave them the original, not the renegotiated one. So they were saying I was behind on my payment and that I had all these late charges. I have faxed and sent certified the correct paperwork and still Santander does not acknowledge what I have given them. They refuse to stand by the new payment. I have tried everything to talk to them and at one point, I thought I finally had it taken care of. Then the next thing you know, I am getting a gazillion calls from them saying I am late with my payment.
Then I keep questioning why online it says I owe one amount, then the bill says a totally different amount and, again when you call, another amount so I have three different amounts they say I owe. I also deferred a payment just to give me time to try and get this straightened out and when I spoke to someone today, they claim the deferment was made in January. I said no, it was not and I sat for 20 min. arguing the point and they still will not admit it was last month. So now, instead of only owing for May, they claim I owe for Feb, March and April when I only really owe for 1 month.
I don't know what to do anymore. I cannot afford an attorney and I'm so afraid I will get up and my van will be gone due to them repossessing it. I am disabled and I only receive SSI and they are literally raping me. I can't afford food sometimes because I have to give money to them all the time to keep them from taking my van. If you buy a car and they say Santander is the finance company, run. Run as fast as you can and don't look back no matter how bad you want the car. They are scammers and they rip you off so bad.

I have a 2009 Kia Spectra which I financed in 2009 for $18,000. 3 years later, after making monthly payments of $457 a month, my balance know is $17,000. How is this legal and possible? I tried contacting the company several times. I even spoke with a supervisor and still they’re not giving a straight answer. I need help!

I noticed a change in my credit report in Feb 2012. It was for an account that was never mine dated 1998. I contacted Santander and received a letter stating that it would be removed from my credit report. It has been 6 weeks and still has not been removed. My credit score has dropped 23 points due to this erroneous report. I have sent letters certified mail and still have not gotten satisfaction.

In the last year, I had fallen behind on my car payments a few times. Each time, I was informed to pay the past due amount and bring my account current to remove it from the repossession list. Each time, I paid the amount and was then told my account was current, but was still called continuously about my next payment. In February of 2012, I was once again threatened to have my vehicle repossessed because I was 75 days delinquent and was told I owed $1,000.00 to bring my account current. I paid the $1,000.00 and was told my car was being removed from the repo list and that my next payment was not due until March.
On April 18th, my vehicle was repossessed without notice. When I called Santander, they transferred me to the reinstatement department and there I was told that I was 90 days past due on my account. When I explained that I paid $1,000 in February and that I was told by their representative that my payment was current and not due to March, the representative stated that my payment only brought me current to January because they go to the furthest date from when I was late and assess fees. When I asked why I was told differently, the representative stated that it should've been explained better to me by the other department.
Now they want another $1,300.00 to get my vehicle out of repossession and would still owe for April. The thing I don't understand is if my car payment was behind 75 days and scheduled to be repossessed, then why was my car removed from the repo list after my $1,000.00 payment if when (according to Santander) I was already 75 days delinquent at the time they accepted my payment. That would mean I was equivalent to 150 days past due. The really messed up thing about all this is that I only owed $4,000.00 on my car.
When I paid the $1,000.00 in February, you would think that that amount would have been deducted, but my owed amount did not change whatsoever. So I went back and looked at my last year of bills received and discovered that even though I have made payments in the past year at $250.00 a payment, my amount owed has not changed. I would like to know how this company gets away with this type practice. I have also noticed that most of these complaints have all came around the same time and seem to be customers that were first financed with Citi-Financial and that most have paid at least 50% of their loan.
Santander will not correctly notate anything on their computers that is discussed. Each time you talk to them, they give you a different answer or reason and each representative you talk to does something different.

I fell behind in my auto payments and my vehicle was repossessed on Saturday, April 7, 2012. I went to my local credit union on Monday to get a loan to pay the balance in full. I was granted a loan and the credit union mailed a check to Santander on Tuesday. I was communicating with Santander informing them what I was doing. I was talked to very ugly several times. I spoke to a supervisor in reference to this and he assured me it would be addressed.
Wednesday, a very pleasant lady named Tracy called me and assured me that the situation would be looked into and she asked me if I had any unanswered questions. I told her, yes and explained my situation and asked her what I could do to get my vehicle released to me as soon as possible. She said that if I had the bank to fax a letter to her on the credit union letterhead, stating the amount of the check and that they would not stop payment or withdraw the check, then she would make sure it got to the appropriate place and she would personally call to have the vehicle released as soon as she got the letter.
The credit union faxed the letter. I called several times and was not able to speak with her. I spoke to a Mr. **, who was pleasant as well, who said he saw the note and they had not received the fax yet. I went to the credit union and saw the letter along with the copy of the check. When I called back I spoke to Antonio, who was pleasant as well. They had not received the fax yet. I called back again and spoke to someone who spoke very fast and stated that they have received the fax, but they could not get the vehicle released until the check cleared and that could take up to 30 days. He stated that neither Mr. ** nor Tracy was available and that he would send Tracy a message to call me that day.
I never received a call and he assured me that she would call me that day. The person I spoke with kept repeating that I was not going to get my vehicle released under any circumstances until the check from the bank cleared. Today is Friday, April 13 and I was told by the recovery company that I probably will not get my vehicle back if I didn't clear things up with Santander by today.

In 2010, I reluctantly co-signed for my daughter Allasha ** to purchase a ‘04 Infinity from the Drivers' Select Car Dealership. Drivers Select told her that the car had never been wrecked. I went to the location to inspect the vehicle and after raising the hood. I observed a Yellow "X" that had been placed on the inside of a fender or below the radiator. This indicated this vehicle had been involved in a crash and the replacement part had been marked. I told my daughter in front of the salesman that the car was overpriced at $18,000.00. I told her she could buy a new car for less.
Needless to say, as a 28 year old, she would not listen and after much debate, I conceded and signed the documents. I told my daughter in the presence of the general manager at Direct Select that I would co-sign but, I would not make one payment because this would be her responsibility. At some point Santander began to call me and stated that Allasha was not making payments. I told them to pick up the car because I was not going to pay for her car.
This continued for several months. I was invited to Allasha's residence in approximately January 2012 and a month later the car was repossessed. Santander Financial sent me a bill for $2,000.00 + and stated that they sold the car and this was the remaining balance on the loan. I told them that they needed to settle with my daughter.
The next letter I received informed me that I owed $8,300.00 for the unpaid balance. The repossession had been placed on my credit report. My credit is ruined because I could not and I refused to attempt to take care of my daughter’s expenses. Santander has called me from the following phone numbers: 214-237-3670, 888-222-4227, 877-720-1108, 469-385-5260, 214-540-2035, 303-302-1410, 214-514-3380 and 866-923-9860.
Now that the car has been repossessed and the company has placed an $8,000.00+ against me. I have told them repeatedly and as recent as 4/11/12, at 9:25 am, I have told them to contact my daughter because, I am not going to pay for the car. It is her responsibility. Now that they have dinged my credit, I want them to stop calling me. There are other records that indicate that the car has not been auctioned. I am aware that I did co-sign for a car that was repossessed. That car was a ‘04 and it had been wrecked when Santander financed the car. Santander did not inspect the car before they purchased the car from Direct Select. This is harassment. I have told them over and over, to stop calling but they will not. I received a call last week when they said they were going to close the case. I received a call today when they were giving me a chance to make payment. I feel totally harassed by this company. Santander has called me.

The loan had been with CitiFinancial and transferred to Santander. We had fallen 3 months behind on payments after 4 1/2 years on time due to many reasons. We had made two consecutive payments 2 weeks apart and were catching up. They repossessed the car a week later anyway. They said we had two weeks to pay and retrieve it. We filed Chapter 13 to refinance the car and house. They were legally obligated to return the car to us. We found out they had sent it 2 states away for auction after only three days. It took 3 weeks of phone calls to get it returned. It was damaged cosmetically and mechanically. It was obviously towed badly. I had to sign a form saying it was in good condition, which I did not want to sign.
But I needed the car and didn't want to lose it again. They repossessed it right after taking 2 payments! So now it needed front end work and I have to replace the missing floor mats and locks. Who took the locks? Somebody also power-blasted the paint off of the fender. I know we were late on payments, but this was unnecessary. This had been a well-maintained vehicle (part of the reason we were behind was getting the transmission repaired). By the way, we were behind on the other car with Wells Fargo, who isn’t known for being easy-going with things like this; when they received the consecutive payments, they, you know, didn't take the money and then the car anyway! And they left the car with auction stickers all over the windows. They just suck and I wanted to vent.

Lies - Temporary Reduction: I fell behind on my vehicle because I am going through a divorce. I surrendered my vehicle and retrieved it back within 2 days after speaking to a service rep on my options. I was losing hope because the monthly payment was too high and though I wanted to keep the vehicle, I needed help with the payment. I decided to borrow money to pay the past due and retrieve my vehicle based on my 2 conversations with the same rep that I qualified for a temporary reduction. She stated she would email me the paperwork and if I didn't see it in my email, to check my spam.
I paid the past due, fees to the towing and never received my paperwork. I called in to check on the paperwork, only to hear that I do not qualify for a temporary deduction. I was livid and started crying because the little hope I had was suddenly lost and now I am stuck with a high monthly payment that I cannot afford and the car will be back in their possession once I cannot pay. It angers me that I feel scammed that I paid $3000 to get the car back when I could have just let this go to auction and used that money to purchase an older working car with no payment.
Granted, I understand that I would still owe a balance, but still I was lied to and now they keep saying I was told the wrong thing and besides all the other problems I have, I am still stuck wondering how was I told the wrong thing twice?

My car was financed with Santander. I financed with another company for a lower interest rate. A year later, I traded the vehicle in. An extended warranty had been purchased. Only 48% of the warranty was used. The car dealership refunded $906 back to Santander and sent me documentation that the money was wired to Santander. In return, I faxed the same information I received to Santander. After two weeks of going back and forth and having to explain the problem over and over again, no one still knows where the refund is. Now Santander is telling me the dealership never sent the request but I have documentation. I have no idea how to get my refund back.

My car loan was setup on Santander's auto payment for 5-year loan. 59 payments were auto deducted correctly. My final bill looked no different than prior bills. It states amount due $464.99. It states: "Account is currently setup on recurring payments." The back of the bill states about auto pay, "You will never have to worry about a late or missing car payment again!" The bill does not state the 60th final payment must be handled any differently. In February 2012, I tried to apply for a different loan and am notified I have a Santander loan that is 30 days delinquent and was denied a loan.
I called up Santander and they informed me that I did not send the last payment. Nowhere on the last bill does it indicate the 60th payment should be manually sent in. I feel Santander has misled me to believe the 60th payment would be auto deducted as all prior 59 payments were. I had to pay $40 extra in late fees. Now, I want Santander to correct my credit rating and they will not do it saying it is my fault this happened. Santander’s customer service believes I should have known that the 60th payment should be sent in manually. I want Santander to correct my credit report so that it does not show I was delinquent on a loan. I am not fighting them on the late fees. I am more worried about the impact to my credit rating and ability to get a loan.

My car loan was transferred from CitiFinancial to Santander. They began contacting me about September 2010 for payment. I sent them proof of payment then they said another month then another. It was awful. They're calling 5-6 times daily. Finally, I took out another loan with Wells Fargo just to make them stop and yes, they got more money from me than they deserved. Now, I am stuck paying but I do not want this to happen to someone else. They must be stopped. I only wish that I could be compensated in some way. It's so hard. Now, I have to pay on this car for years more.

They continued to allow me to pay late due to homelessness, severe health conditions (including hospitalization) several times, and car repair costs in lieu of monthly car payment. My car was financed through CitiFinancial. When the loan was 2 payments away from maturity, they transferred my account to Santander Consumer USA. I was never informed. Then, I continued to make payments. Now, the car was re-possessed and sold at an auction that I was never notified. The business that stored my car said Santander picked up the car just 2 days after they repossessed it on January 31, 2012. I was devastated. I had made prior arrangements to get caught up. I called them just as many times as they called me. If I could afford a lawyer, I would.
My car was paid for and all they wanted was the deferment, interest, and late fees totaling to $4,000.00. By the way, they say they sold my car for $1,800.00. I asked for documentation of all of this, and they said they already sent it. When I called recently, demanding documentation and to speak to the supervisor, he said they would forward it today, March 20, 2012.

I bought my car with loan from CitiFinancial Bank in January of 2006. At some time between now and then, my loan switched to Santander. I signed nothing, it just happened. Sparing the details, I got a $19K loan, have made 74 payments and Santander quoted me (on the payment that should have been my last) that I still owed them $8K. So after making payments for 6 years, I still owed 42% of my loan due to irregular penalties and fees - Paid to date: $28,996.22, Interest: $15,949.71, Charges: $905.73, Misc. Charges: $865.78, Total: $46,717.44, Still owe: $8,306.13
I sold the car on Monday (and my payoff is still increasing) because I realized that I was locked in to a subjective loan that I would not be able to ever pay off. I also was tired of the continuing harassing phone calls made to me at home and work, my family and my friends. Do not have your car refinanced by Santander Consumer.

I am currently 45 days behind on my car note due to my husband unexpectedly having to go on disability. I previously called, emailed and sent a written request to this company to see about deferring a payment. This was mid-December. I never heard back from them. I called again at the end of December. I knew I was going to be late in January 2012. I was supposed to get a call from someone to explain my options. No one called.
January's payment wasn't made until the first part of February. They began calling me 10-15 times a day--never about helping me but about if I could make a promise to pay. I stopped answering the phone. They call up to 9 pm and even on Sundays. Finally, I called them on 3/16/12 to try to resolve the situation. I told them once again that I needed to be able to defer a payment to be able to get my account current. I told them I could send February and March payments but honestly could not afford to. They said that someone would contact me about financial assistance.
Someone named Debra called me and left a message. I tried to call her back but I got someone else. Someone named Omead called me. When I called back, I again got someone else. Omead's supervisor called me and left his direct line for me to call. When I did, there was just voice mail. I left a message and called the other number left for Omead. As expected, I got someone else. I talked to them and tried to explain the situation. She said that "no one" has a direct line--that she doesn't know why anyone would say I could get assistance whenever I "promised" to make a payment for February and March by 3/23/12.
For one, I "never" promised a payment because I wasn't sure if I could afford it. And that being said, I never gave them a date. By the time the conversation was over, I did tell the lady that since she said I could not get assistance, the payment would be in the mail. They are in Dallas so I told her that they should receive it in a few days. She said it would be 10 days before they got it because of "mail-sorting" and the account would continue to be past due regardless of our conversation and payment arrangements.
Phone calls would continue until payment was accounted for. This was all on 3/16/12. Then, on 3/17/12, I get another message from Omead's "supervisor" to call him as he does have assistance for me. I am scared to dial the number or answer the phone. If he has assistance, then why is the rep I spoke to so adamantly saying no?

I paid off my car loan in 2010 and never received the title. They claim they mailed it to me and it should have been returned in the mail if I did not receive it. I feel as though a title should be mailed certified to verify it was signed for. I received conflicting answers from multiple associates as to where my title went. The first advised it was sent to the DMV and the second person claims it was sent to me. When HSBC sold my loan to Santander, I had nothing but issues. They lost payments that were cashed and customer service was awful! Maybe my lost payments are with my lost title? This company is a joke and has now cost me the expense of filing for a lost title!

I have two auto loans with Santander (originally HSBC). I suffer from an illness that I was diagnosed with in 2011, which caused me to miss several months of work. I was compensated through a short-term disability benefit which paid 60% of my salary. I got behind on payments. I am also going through a divorce, and as part of our Separation Agreement, my wife was to have use of our 2005 Chrysler Town & Country mini-van, as long as she made the payments.
I am a co-borrower on the loan. My wife filed Chapter 7 without Reaffirmation and then dropped the car off at my home, leaving me responsible for the payment. I contacted Santander to see if they would work with me. I was told, "You are covered as part of your wife's bankruptcy....all you have to do is either continue to make the payments or return the vehicle with your wife's permission and that's it." I knew that could not be correct, as Santander can legally pursue me for the deficiency balance owed.
I spoke with several people in the Bankruptcy group who all said what I previously quoted and I asked to speak with a manager. The "manager" informed me that I was correct and that Santander would pursue the deficiency balance if I surrendered the vehicle.- completely different from every single representative of that company that I spoke with in nearly three hours on the phone.
This is deceptive and unethical business practice. The manager filed a complaint on my behalf to the Office of the President...gave me a complaint number and said I would receive an email within minutes...that was 4 hours ago. This company should pay stiff fines for these types of practices.

I paid off this company and never received my title. Now I have to buy a new title they say. It is their responsibility to have seen to it that I have received my title. They said they never received it back so I must have got it. I do not think they ever mailed it. I have a secured locked mail box. I should have received my title and I am mad.

We purchased a 2008 Mustang brand new. It was originally with HSBC. I became unemployed shortly after but HSBC worked with me to bring my payments current. Then Santander took over. All of a sudden, I had all kinds of fees and they called continuously all hours seven days a week. We have been paying $569.77 for almost four years on a loan that was only a little over $20,000. They said we have had eight deferments and still owe over $23,000. How is that possible? There is no way I had eight deferments. The life of the loan wouldn't allow that. Now, after paying some crooks out of California to help us, which they didn't, they just took our money (that's another story), I did give Santander almost $1200 in December 2011 while these crooks were working on it. Now, the car is passed 90 days because Santander says we have no more assistance they can offer. What can you do at that point but surrender the car! We've already paid over $17,000 for a vehicle that's owed over $23,000 that was only a little over $20,000 when we first bought it! How can these people get away with this? This is the good 'ole USA, right?

Back in January of this year, I backed my car into a bush at the end of my driveway. I took my car to be looked at by a claims adjuster for my insurance company (Progressive). After assessing the damages, he issued me a check for $1526 along with a list of repairs needed to be done to the vehicle by their choice of body shop or my choice. Because my car has a lien on it, the check had my name as well as the lien holder’s name on it. I was informed that once I decided upon a body shop to fix my car, I needed to send the check to the finance company for endorsement so it could be sent back to me to pay for the repairs once they were completed.
At the request of the finance company, I sent the check by next day to the insurance department. I was told they would do the same once I informed them that the repairs to my car had been completed. That was over a month ago. The repairs to my car were completed over three weeks ago and they refuse to send me the check to pay for it.
They have given me several reasons for not doing so expeditiously as I was told they would do. (1) The form that the shop faxed over to them was an unacceptable form. Why? Because they did not give enough details about the repairs that were done to the car. (2) The amount that I paid for the repairs to my car did not correspond with the amount of the check that the insurance company issued to me. (3) The work that the body shop wrote on the form did not justify the amount that was spent on repairs. (4)The body shop that did the repairs did not do the exact amount of things listed on the insurance estimate printed up by the insurance company. (5)The body shop that repaired the vehicle did not repair the car the way the estimate from the insurance company listed that the repairs needed to be done. And finally, (6) I needed to justify the amount of money that I paid out of pocket to the body shop to pick up my vehicle. Forms have been corrected and faxed to Santander three times and still they come up with excuses for not giving me "my" money! I paid the body shop $1800 cash to get my car and I am sick and tired of the "stupid" excuses Santander keeps coming up with for not sending me the check as they promised they would.

I am thinking of becoming a part of a class action law suit against this company. I purchased a 2007 Caravan that was financed by Drive Right Financial. In about 2010, automatically it seemed my balanced doubled. I did not see any difference in my principal even though I was paying $526.29 a month for a couple of years. I became ill and unable to work along with being laid off and asked them to lower my payments, only to find out I still basically have what I had originally purchased the van for years ago. These people are now sending remote calls to my relatives and former job, going to relatives' homes, and harassing and intimidating my teenage daughter.

I, too, had my HSBC auto loan bought out by Santander. Same story as most on this complaint board. I have been paying extra on my payment every month. My payment is $457 and I pay them $500. But now that I am at the end of my loan, I owe thousands? They claim that it consists of interest and late fees but how can this be if I always paid extra? I believe that this company is scamming people out of money on a daily basis. It's just a shame that nothing has been done about this.

We financed a 2002 Nissan quest back in April 2007. Our contract was originally with Drive Financial. A few months later, Santander took over the contract. We've had a couple of late payments; the monthly payment is for $378 and some change. Every month a rep from Santander will call and ask for the payment plus late fees which now they say is about $1,200.
The contract will mature in June of this year. Well according to Santander, we still owe $7,400. Now does this make sense? The rep from Santander says we've had 4 payment deferments but I can only remember of 1 back in 2008. Even if I had 4 deferments, that would set us back 4 more months and obviously these people don't know how to add. First of all, I still don't understand how they came up with $1,200 of late fees and second, the payoff of $7,400. Come on! Five months multiplied by $378 months is $1,890, not $7,400 plus 4 deferments equals to $3,402, plus $1,200. It still does not amount to the $7,400 that Santander says we still owe.
On February 8, 2012, my wife made a payment and they debited the account, but a couple days later they were calling asking for the payment saying that we never made it. My wife went online, pulled up the transaction history from the bank and it shows that the payment was debited by Santander. We faxed over a copy of the bank and still they don't know what happened to that money even after they saw the proof. I have asked them to send me a history of my payments and the deferments which they told my wife that 2 deferments counts as 4 months, and till this day I have not received the payment history.
They still call to ask for the payment. The nerve of these people. I think this company is a bunch of crooks. They have inexperienced agents who don't know how to talk to their customers. They try to intimidate by making false statements. I, too, would like to talk to anybody else who is interested in taking these people to court.

I originally purchased my car with HSBC and a couple years later, it was sold to Santander. I have always made my payments within the allotted amount of time and never had a problem while my loan was with HSBC. I decided to pay my car off early and called Santander a few weeks ago to get my payoff. Somehow, my payoff is almost $2,000 higher than what my loan agreement was for and that's with paying it off over a year early. When I asked them why they stated that, it was because I was always late while I was with HSBC. I told the rep that his information was incorrect and that I wanted to talk to HSBC. After lots of arguing, he finally gave me the number to HSBC. I called and spoke to HSBC and they stated that I had never been late while my loan was with them. I called Santander back and their response to me was "well we don't care what HSBC says, they don't have your loan anymore, and we do" and hung up. How is this legal? They can just charge me whatever they want and get away with it?

I've talked to Santander 5 times over the last 2 months, wanting to know what is happening to the extra money I send in each month with my payment. When my loan was taken over from GE on 4-21-2011, my monthly Santander statement reflected me paying more than $100.00 each month. Then in Aug. 2011, my statement skipped me ahead a month, and billed me for my regular monthly amount. I expected my statement to continue to be reduced by the $100.00 over payment each month, but it stopped. Now, no one at Santander can tell me where my extra 7 months, or $700.00 has gone to. I've been told "we will investigate, call us back in a week", and "we will have our accounting dept. check it out, call us back in a week, and we will have an answer". Today, a supervisor told me she would look into it, and call me back, but did not. I don't even know where to go from here.

For the month of Dec. 2011, I didn't know I was to make a full payoff payment, so I sent in regular payment of $371.20. They informed me that I need to make another payment payoff of $1024 and change. So I sent it in to my account with this. In the meantime I was told I should make another $371.20 payment just to make sure as they still hadn't gotten the $1024 as yet. So I ran down to Western Union and did it right away. That same day they posted my payoff payment (and they signed for the extra payment for Western Union same day).
I called for my extra payment to be returned to me. It's been since Jan 31st 2012. Now every couple of days a man named Matt ** from the president's office says they don't have the Western Union transfer. Western Union said they have sent them request for my money to be sent back to them and Santander keeps saying they haven't heard from Western Union. I'm sick and tired of this mess. When someone pays off their car it should be a pleasant experience. Well, it hasn't been...and I've had it. Listen to this Matt ** from the president's office calling me and telling me, "I have called them and we are just waiting for Western Union to give us the okay". Western Union says they have sent three requests for them to release my money. What the hell is going on? I want my money back. I'm sick of this. You people need to get it together and quit lying to me. You need to release the money to Western Union so do it. And I'll never ever use you people again. It's been an awful thing I've gone through just to pay off my car (I want rid of you people, release my money now.)

I posted a check into Santander on the 9th of January 2012 for $2430 for PPI from Black Horse on February 24, 2012. The money was taken back out of my account and returned to the Black Horse (7 weeks later) without any letters or phone calls to tell me this would be happening from either company. It has now made me $2430 overdrawn with the bank and I’m not sure what I can do about it.

I bought a car from HSBC in 2006. They sold it to Santander consumer USA. I've had nothing but fury and hatred for how they run. I have made all my payments, and been 10 days late about 12 times. I have 6 payments left to carry out my end of the contract, but they still have my balance at $5,000. I've called and have gotten the runaround so many times. I'm fed up. My contract says nothing of those extra fees, except the late fee. I'll take responsibility for that. I called awhile back to ask about the late fees, and the person said the only fees I can get are, if I'm over 10 days late on a payment. This person lied to me big time. I called again to ask about the fees, and was again lied to. Now, I should have a balance of $2,200, but according to them, it's for $5,000. I'm sick of this corporate greed. I'm not alone. I've read hundreds of complaints just like mine.

We filed chapter 13 10 days ago and we talk to Santander about this since the harassing calls were daily, even at 10pm they would call. Now on 2/19/12, the come and repo the truck after we spoke to them Saturday 2/18 and gave them all the info they needed to contact our lawyer but instead they put in the repo order that day. This company is the worst one ever all the like to is harass people and over charge people. Our truck on our last statement received in January said we owed about $5000 on loan but the repo papers claim we owe over $6000 left on loan. How can they keep doing this to people they should be sued by everyone who has to deal with their harassing and shut them down, why let them keep scamming people when it’s hard enough now days.

Santander purchased my auto loan from my original finance company and it has been nothing but pure hell ever since. I got behind in my payments because of illness and was not able to work and called Santander to weigh my options about making payments. They told me they could defer my payments for 2 months than start making regular payments after that. Wrong! That never happened. At 2:00 am one morning, my SUV was repossessed and I had to pay $3500 to get it back. I asked the lady there if this took care of all the back payments and whatever I owed Santander prior to repossession. She said yes. I called Santander. They said I still owed them back pay of $1500. I asked for what and they could not explain why .Why is this company still in business? I"ve been paying on this SUV for going on 6 years. I don't want to go to my grave owing on this vehicle. It has been nothing but a nightmare dealing with this company. Can't anyone help out the consumers here?!

My husband and I financed a truck through HSBC in June of 2006. HSBC went out of business and sold our contract to Santander in March of 2010. Until that time, we had no problems with our account. My husband is military, so we have a military allotment set up and the amount is automatically deducted every month. In November of 2010, we received a call stating that our payment was 30 days late. We knew this couldn't be because the money had been deducted from my husband's account and we even called the military allotment processing place to verify that the money had indeed been received by Santander. They said that they would check their records and to call them back in a couple of days.
My husband called them back and they had admitted to an "accounting error." No problem. But the next month on our statement, we were charged a $26.43 late fee. My husband called them again, and again, they apologized and said they would correct the mistake. Our problem now is the fact that our truck is due to be paid off in May of this year, and we will still owe about $1600. Never being late, or missing a payment. We have called several times and have gotten the runaround and them trying to explain this. They say it is due to the interest charges and late fees, which we shouldn't have! We asked them if we have a contract with the set amount paid in interest. How they can justify adding almost $2000 to that? We asked what their rate is and they can't or won't give us any answers. They did tell us that if we didn't pay it off by the maturity date that they could "extend" the loan. After reading all of the complaints about them, I am now horrified that we are possibly going to end up getting screwed! I am going to contact our own post consumer affairs officer and JAG on Monday to see if they can assist me. It's a shame that they're getting away with so much and so many have been affected by their shady business dealings!

Santander is stating that I owe more than what the car is worth. They should not get away with taking advantage of people and their financial situation. I have a 2006 Malibu that was originally financed by Triad Financial. The loan was bought by Santander in 2009. I was notified by a letter from Santander that said, "this service transfer does not affect the original terms of your auto loan contract. " However, this was not the case. I am being pursued for payments I have made and my interest seems to change monthly. Santander says I am 3 months behind because they took my double payments but did not credit my account for the next month, as was done when I was under Triad. Yet, when you look at my principal, where the extra payments supposedly went, there are no credits. Instead, my principal has grown.
I am at a loss what to do. I have contacted Santander, but heard nothing in reply.

I purchased a truck in October 2007 and it was originally financed with Drive Financial. Approximately six months to one year after having the vehicle, the loan was then purchased by Santander Consumer. It has been a nightmare and I have been harassed, shortchanged, and disrespected.
My elderly mother has been harassed and I have been embarrassed due to collectors calling my family members and telling them that I was behind on my payments, and that I was going to have my car repossessed.
I put $750.00 down on the truck and my payments were $504.00 a month, and I paid on it for approximately four years. I estimated that I have paid close to $25,000. 00 on the truck. I asked them for a pay off and they told me that I still owed $16,000. The motor was going out and I told them to come and get it. I don't know how I can still owe this much money on the truck and I've put this much money into it. I don't want to go to my grave paying for this truck.

I had my loan with Citifinancial until 9/2010 when Santander took over. I was stoked to be paying my car off Oct 2011 only to find out they have me owing $3606? I was devastated! I then get a statement stating my term date is now 12/20/11 when my contract and all other statements said Oct. 20, 2011. I requested a printout from them, went back through most all my bank statements from day 1. I found 3 payments missing and several hundreds of dollars of charges? I have faxed the bank statements, spoke to someone to verify the fax was received the next day, made a "safety payment" while they verified the info I sent to them, only to have a repossession guy knock on our door today. Santander had no notes of my conversation even though I took down names, times. I had to send all paperwork again and check back in 24 hrs to make sure they got it! Again?
am seeing a pattern that I can't seem to change! By the way, Santahder is not the legal lien holder on my registration and is not even listed as a company registered to be a lien holder according to DMV. Citifinancial is listed, but there is no notice of a successor, no phone number etc. This Satan company is sketchy at best, and doesn't seem to answer to anyone?

I have a car that was financed with HSBC auto finance they have since been bought out by this company. I filed bankruptcy in 2007 along with my husband and the car and an SUV were filed under the the case. In September of last year, the SUV was wrecked and totaled out and payed off by the insurance company. Leaving the car and some credit card bills the case was converted to a chapter 7 in December. So we called the company to find out what the balance was on the car after contacting them on 4 different occasions, I was told the balance was $5,000.00 and something dollars. My case was about to be closed this year and we paid our payments as scheduled. When I spoke to my attorney, this morning he said in his computer it is showing we owe a little over $400.00. When the case was filed in July of 2007, they filed the claim for $8485.20 and our employers were sending the payments in for us so we made our payments. I do not understand how this can even be legal for them to do this. It is like in seven years we have not made any payments towards this car .

I am currently going through a separation/divorce and have been unable to keep up with my payments. First, I tried to work with Santander to lower the payments, and they refused. So I had no other choice but to voluntarily surrender the car. I did. They took their time picking up the vehicle. In fact, I had to make a complaint to the BBB for them to do so. Next, they refused to give me a receipt for the car they removed. I still do not have proof that they in fact removed the vehicle. I am still looking for some resolution.

I called and spoke to a lady from customer service. I ask if my 2011 tax statement had been mailed. I was told no. I stated that by Federal Law, these forms were to be in the mail by January 31. I am now on the 6th of February, and waiting to do my taxes. I need this to finish them. I have everything I need, except this form. This company bought my loan from GEMB in April. I paid this off in June. It took me 6 weeks to get the title to my unit. They were sent a cashier's check, which was in their bank about 4 weeks drawing them interest, before closing out my loan. I was told by GEMB that they were to send me all the interest paid information, since they bought the loan. People need to know to stay away from this company.

I was very disappointed when my car loan was sold to Santander a couple of years ago. I have since paid it off, but keep getting phone calls and letters from them. I even got a letter today that was a supposed to refund for me overpaying, however, the letter is to a different person (same name, totally different address) and a check made to me. I called to verify if this was legit but can't seem to talk to an actual person. When I finally got to an actual person, they told me that I owed them more money. I have paid off my car, how can I owe more money? This company needs to be taken to court. I personally think they are scam artists.

I bought a new car by the end of November 2011. I was offered darker tinted windows on my new 2011 Toyota Corolla with a $1,000.00 cash back called 'Christmas money'. I made an appointment in December with the service dept on the 28th, at 8 AM. I went in for my tinting, and was told they are already done. Needless to say, I drove off with no additional tinting done.
I was told I will get overpayment from Santander. Mind you, this is Jan 30, and I am still waiting for the check from them. Today, I got passed on to the "president's office", with another story of more time needed, to locate the status of the check. What is the problem in this picture? I would so love my older car back, with no runaround, and pawn it off, as though I'm the problem, which at this point I'm sure I am. What is my recourse for resolution?

Santander Consumer USA will not work with me to help get my loan paid off. I am a totally disabled worker and is now on Social Security Disability benefits with a fixed monthly check. They will not work with me and give all sort of excuses as to why they can not help. I feel that they are discriminating against the disabled, by not working with them to resolve present financial situations. I have only 6 months left on the loan, however, I am now November, December 2011 behind and January 2012 is now due.
I am worried that my 2002 Jeep will get taken which will leave me without any way to get to all of my doctors' appointments and other places I am required to go to. I have tried to work with them since I became disabled back in January 2011 and have used all of the money given to me to either repair the vehicle or make the payments current. I have nothing left.
These people today alone 1/30/2012, 6 times under 6 different numbers. Along with 30 phone calls to my apartment under new call/unknown in the past two weeks alone. If I don't respond, they call my family and are totally rude and demanding that I call them immediately. I am so stressed that it has affected my disability to the point of making it extremely worse. Please help anyone whether legally or personally with an answer.

I have a 2003 F350 truck. The loan was transferred to Santander a few years back. The loan matured on 11/25/2011. I went online to view my balance, and it was $2,600 over what I owed for the last payment. Subsequently, I lost my job. I immediately called them and asked for a breakdown of the extra charges they say I owe. They refused. I mailed 3 letters, 1 via email, one via regular mail, and one via certified mail, and got no response. I told them that I cannot pay over $3,500 that they say is due all at once at the end of November.
I had filed for unemployment, but it would not be paid to me until the end of January. They informed me that I could continue to pay the regular payments, until the loan was paid in full. I only owe $600, not $3,400, as they say. They will not give me any reasons for the extra money on my account. They call my home 6 times a day, even though I have contacted them 4 different times, and they have agreed to allow me to pay the payment at the end of January (which I have sent to them). I am afraid they will try and repossess my truck, even though I am doing everything they say to do. Do I need to get an attorney? I wrote on my check that by cashing it, they agreed to the terms set forth in a letter I attached to the check, which outlined what I have been told.
Also, I was divorced 4 years ago, and they call my home, asking for my ex-husband, even though I have sent them divorce papers, etc. What are my rights? These people are unreal. If they take my truck, I will never get another job without transportation. Now they are harassing me at my home, with the wrong name, and I am remarried. My husband is not pleased that they are continually call, asking for my ex-husband. I have told them 10 times, they have my name wrong, yet they still call. They do take my checks with my correct name.

I had a pickup financed with this company. When I chose to sell it and pay off the loan, they refused to send my lien release due to the fact that my bank had sent the payoff as of January 20th. They added finance charges through February 2nd and would not remove them as a balance owed from my account. Their response was it would be reimbursed 45 days later! They were paid in full through January 20th. Why do they get to keep my money for 45 days? Maybe to draw interest from it?

This company is a consumer predator. I put three notes at the end of my contract. The company wanted me to sign a loan modification agreement. I ask them where the additional charges came from. They told me that those notes accumulated daily interest in the amount of $5, 517.00. After talking to them trying to get an understanding, I was told that if I refused the agreement, they are still the lien holder. When I received a copy of my credit report, they had my car as a write off even though they continued to receive my money until Dec. 2011. They repossessed my car. This company needs to be out of business. How are they able to have all these complaints and still be in business?

Well, I'm in the process of taking them to court because I purchased a 13000 truck and put down 5000. When I went to buy it out, they're saying I owe another 15000. WTH. There is no way I owe that much money. I've already put in about 12000 plus the 5000. Now let me say I have been late with my payments since I was laid off in 2010. I've been trying to catch up since. I still would like the judge to see this and if i can get others involved and we work together, we might just win. I know someone who took their bank to court because of the similar situation and she won and the bank had to pay her some money. So it wouldn't hurt to do the same.
For people like me who had their identity stolen and have bad credit cause of it banks look for those they can rip off. I'm not having it. In the course of my wife’s truck loan, somehow Santander picked up the note, not the original lender, so they somehow lost a payment and said they never got it. Our records say otherwise, they charge outrageous fees and late charges. Talking to them gets you all the runaround for hours at least 6 people and no one can help you straighten out this problem they have created.
They will not understand that payroll goes in the bank biweekly. For direct draw, they take it whenever they feel like sometimes late and sometimes early knowing full well that the funds of the payee only go in on the 15th and the 30th to say they have not received funds. Statements from the bank show otherwise and try to do so again is stealing.

This company is violating every right a consumer may have. They call my home over 100 times even after 8 pm and they call my friends, my family, and my job. The more I pay, the more it increases; I never see a decrease in the loan. I hate this company, and they deserve to be sued to let them know you cannot treat your customers as animals. They have threatened to take my vehicle if I do not pay the amount they are asking for and their fees are outrageous. You cannot afford to be late on a payment.

They repossessed my car on Jan 5, 2011 and they didn’t have a right to. It was formerly Citi financial loan and Citi had a lien on it, not this company. They are just collecting a debt for them I paid and paid on this car but the loan would never drop down any. I receive a letter after they repossessed it saying they were going to sell it and I was responsible for any amount left owed. They even wanted us to still pay payments after they repossessed the car. They are not a BBB credited company and should not be allowed to stay in business with the consumer complaints against them. I would rate them nothing with the experience I had with them.

I received a letter that my Citifinancial auto loan was sold off to Santader. At first, there was no issue. Once I lost my job and wasn't working for two months, I had issues. Santander had me believe they would repossess my car unless I sent them a lump sum of $800. They told me to borrow or do something to get the money. They also stated that once I paid them, they would work with because it sounded like an affordability issue. They did not work with me and have been incredibly harassing me. They call my place of work, which I have asked them to stop on numerous occasions.
I am paying large payments and still never have my account payments caught up. Today, I had a person call pretending to be from another company calling to get corporate HR information and attempted to get more information. He would not state why he was calling but wanted to confirm information about me. My friends and family have also been getting harassing calls from them. I would rate them 0.

The dealership misled me to believe I could get refinance through this company. They lied too. The car was new. Then I was matched up with Santander Consumer USA (the devil's child). Constant calls and lies; harassment and calls. Even when you agree to make a payment or if you paid 2/3 thirds payment, they tell you did not pay anything that month or you speak with 10 different representatives in one month about the same thing over and over even when you made a payment. Then they play nice and say they will assist you with your account so your payments can be lowered. They are 100% liars. My credit has been destroyed because of Santander USA. I hate the fact that I ever let the dealer put me with them. They say they will not repo your car but I know they will I can feel. Santander misled me to believe they were a finance company but they are predatory lenders.

I have been going back and forth with them over my car payments for the last two years. I was told in December 2010 that if I made two payments, then they would bring my interest rate down from 18% to 14%. Of course, no one knew the person who told me that. It is always, 'this is a different department and we don't know that person you are talking about.' My 87-year-old grandmother had to change her number because they called and harnessed her so much, not just her but a couple of my friends. My car was repossessed and I'm still getting the run around about how much money I owe them after I got it back. Something needs to be done about these lying people sitting in those offices.

I purchased a 2004 Pontiac Montana and got financing from Drive Financial. Then it was sold to Santander. I've been out of work, lost my husband and recently, had an accident and they could care less. As it turns out, they charge me more even with their so-called special deals and deferred payments. They charge erroneous fees and they are constantly calling my friends and family. I am paying $417 per month for a beat up vehicle and being harassed about it. I am joining the class action suit with Sokolove law firm against them. Everyone else should do the same.

Can I give them zero stars? My vehicle lien was originally with Sovereign, and then was taken over by Santander Consumer. I paid on-time every month, and even paid off my vehicle early; however, Santander still (as of 1/4/12) has not released my lien in the state I currently live in. They released the lien only in my previous home state, and despite phone calls every couple of weeks for months, they have not released it here.
I even called the DMV and got a phone number for the Lien-Release Help Desk and gave it to them. Still nothing. Do you think these people (referring to the 8 or 9 different representatives I've talked to at Santander) care? No, of course not. They got their money. I am now stuck with a vehicle that I paid in full over a year ago and cannot sell, trade or even dispose of it because they won't release my lien to allow me to have my title. What's worse is that my vehicle now has over 200,000 miles and is becoming unreliable.

Santander Consumer USA; I cannot believe all these negative comments. If I had researched them, I would never have gone to them. I am now getting a contract through them to review my account. I make my payments every month. They are rude and don’t know how to explain how my car was $13,000.00. Then online, it doesn’t tell me the amount with interest ($28.000.00) now how is that plus $5.68 per day between payments? Isn’t that double interest? It’s like paying the car three times off.
Even when I make extra on the payments, it somehow gets eaten up with some sort of fees they charge for random stuff. I tried finding out how to pay on the car without interest, but they didn’t know how, and the ones that did answer, their answers were all different. For 3 years now I’ve had this car and $325.00 a month, this $13,000 car is still only down to $9,000 something? When I get the statement in the mail, I will be talking to a lawyer about the interest. These people are crooks and they need to go down.

Santander is unbelievable! After reading all the complaints against Santander, my mouth flew open. Wow! I called Santander on 12 December to see about a deferred payment because I was in a car accident back in May 2011and had been scrambling like crazy to pay all my bills, including my truck payment (I didn't think about gifts for Christmas, food and nothing else. I was already depressed because of this). The CSR told me to call back in a week closest to my due date which is 24 December 2011, so I did that. I called them on 22 December 2011. The guy came on and I asked for a deferred payment. He told me I could do a one month or two deferred payment.
I said, well, to be on the safe side, I want a 2-month deferred payment and if I only need 1 month, I will make my payment the following month as scheduled. Then we had to do a recording stating why I needed this deferred payment. I explained my heart out. I felt like I was on trial with all these questions. (I have never been late on my truck payment) never been late! Then I had to give a friend’s name for them to call to see what type of person I am. (Didn't they do that before I was approved for the truck loan?) I asked why. He said to get a character inquiry about me. Wow! I said darn.
Well, to wrap this up, I called today 26 December 2011 to see if I was approved for my deferred payment. Nope! Can you believe that? But I was told that I could make a minimum payment. What part of I don't have any money right now they didn't get? I wanted to know why not and if I could speak to upper management to the person who made this decision? Nope! I'm so upset right now. These people just want their money and they don't care how you get it. I want to give them this vehicle and tell them to shove it! They are not compassionate to your struggles or unfortunate circumstances. Shame on you, Santander! To everyone, run; do not let Santander finance you!

My original loan was with Citi and I began in December 2007. One day, long ago, calls began to come into my job-automated messages I left on my voicemail at work. My co-workers received calls but they would lie about who they were. My friend from church received a call from Santander, USA. My last work assignment to this day receives calls from Santander, USA. The killer to all this is from day one, I set up my payments every 2 weeks. The payment is $570.00. I actually pay $300.00 every two weeks. After they receive the first payment from my bank or as I have learned the moment it hits their queue, the nightmare begins.
For the last 2 years, I have been traumatized by Santander, USA. I requested payoff information a month ago and I was told it was $18,000. The original price was 21.5 thousand so how do you pay $600.00 per month with 2 deferments in the last 2 years and still owe the principal. They are rude, dogmatic and they will bully, if allowed. I have just joined a class action lawsuit and I am glad to be an American. We, the people, will not allow these gangsters in business suits to terrorize us. We can speak up and speak loudly, in the name of Jesus, they will not get another dime from me. They are straight educated thugs, not the CSRs, its bank and company. On the real, not only that it must be working, Santander finally has got the message. Keep screaming guys until we are heard.

Since they took over my loan from CitiFinancial without my consent, it has been hell on earth. I paid my loan off on October 4, 2011. They refuse to give me my title saying I owe them $2330.00 in interest but they refused to show proof of how they came to these charges. They call me about 15 to 20 times a day and wanted to give me a loan modification and a charge of 9.5% interest on top of penalties they say I owe but they won’t show proof of. I sent a cease and desist letter which these idiots received on December 6, 2011 per the return receipt but continue to violate the letter. Please if anyone is interested in going after them with all the legal grounds we consumers have, please contact me because I want to be there when they are put out of business. They are a horrible company.

I have a 2004 Nissan Altima. My original loan holder was Citi Financial. I have always paid my car payment of $526.00 on time. Well, I can say within the month that it is due. My payments are due on the 9th of every month. Citi Financial always worked it out with me because I am a nurse and only get paid once a month from my employer. I have never made a payment past 30 days. Santander's website never works to do payments. So I always have to mail or due Western Union Speed Pay. Santander posts the account but still has reported to my credit report that I was 30 days late 3 times in one year—not true. I purchased the car in 2007 with Citi Financial and have never been over 30 days. Also my uncle co-signed for the loan. If I am 3 days late Santander calls me 15-20 times a day none stop. Then they call my uncle in another state at his place of employment, which causes family conflict like I’m not paying my bill.
I can even post a payment with Western Union and get a confirmation number and they ** still call me, asking for the next month's bill. I also pay on Buick Ranier with another lending company, Consumer Portfolio. I have no problems, never. They reassigned my due date I have never been late. As a matter of fact they have an auto pull on my account to assure my payment with Santander USA. This company has no respect for the clients and shows no trust to the clients. Everyone needs paid.
I understand that, but ** it’s a little easier to get up off the money when you don’t have to live by threats each and every month. They even try calling from other state phone numbers—how creepy is that? Please, I’m speaking for all the people who are having the same problems that I have with Santander. Can't new collection guidelines be put in place for the people who really do pay their bills and stop making us feel like we are not responsible? Help! This caused embarrassment, frustration, and family conflicts about payment on time.

Santander bought my AR from Beneficial. This was after the economic crisis began. I lost my work during this time and had to deal with them when payments became late. They would start calling me as soon as my payment was past due, within hours of their system showing past due. One CSR was so rude that I pretty much told him off and told him not to call me again. He called me every 15 minutes for hours! Their reps are also notorious for starting their calls at 7 am and lasting until 11 pm. They have even called my family members when I refuse to answer their incessant phone calls! I recently had the good fortune to get my car payments caught up and wanted to pay off the loan completely to be done with these leeches.
They quoted me an amount that is exactly my car payment times the number of months owed. They are not deducting the interest although this is a simple interest loan. I have questioned this and get the response "we are taking the interest off". So I have been setting them up since. I am making my car payment two to three weeks early so that I can show in my account that this actually reduces my next car payment. Now I want to go in for the kill and hire an attorney and/or report them to the Feds who control that industry. These guys are a sham and should not be allowed to do business in the US!

This is another negative for Santander. On Friday I paid off my Wrangler via urgent Western Union. On Sunday morning, the tow truck was in my drive trying to repossess my Jeep. I had my receipt in hand, but apparently the repo company’s order trumped my receipt. The driver was nice enough to wait for me to get a phone call in to Santander before leaving with my paid off vehicle. I called customer service. I told them the situation and handed the phone to the tow driver and let him fight these **. Santander told me that the Jeep was off the list and congratulations for being paid off in full on Saturday. And they said that they would send me a refund check as I overpaid a couple of bucks.
Now the tow driver left but told me that there are other companies watching for my Jeep and they would probably try again to repo it if Santander doesn't send the orders to cancel. I thought I was done dealing with these people. And even after paying off the bogus amount they say was due, they still haunt me. Never, ever would I deal with these people again. I suggest that no one does. I will continue to fight them until I feel things are resolved to my satisfaction. But it's not easy without legal help.

We recently filed chapter 7 and surrendered our 2006 Chevy. We only owed around 5000 dollars but with all the miles, we were advised to give it up and not take a chance on it. We had a court order to surrender this vehicle and was told that they would contact us when and where to do so. That way, we could be ready and make sure everything was out of it. They said that since it was a court ordered surrender that this is how they handled it. That they did not treat this as a repo where they come anytime in the middle of the night etc. Well, to make a long story short, they came in the wee hours on the morning, moved two cars out of the way, with a tow truck, drove through the yard and took the vehicle that was unlocked with the keys in it, of course loaded with a bunch of our personal things.
Now we don't know who? Can't get a answer from them to go get out things. I still have some of the rear seats on my back porch that they walked around to get to the car. Now we our trying to get another car, and the car loan that we paid on for the last six, almost seven years at $385.00 plus $10.50 just to make a payment per month. Well, Santander wiped out any record of the loan from the credit bureau. So we can't get a loan because they erased any payment history. We had that dropped the credit score to zero. Every car dealer said that they have never seen or heard of this happening. Has any one else? Can they do this? What can we do? You know with that extra charge they added on just to make a payment the car would have been paid off. We paid over $20,000.00 and have nothing to show for it. Thanks Santander. We need a class action law suit. Thanks.

These people are absolutely ridiculous. I originally financed my car with Drive Financial and Santander apparently bought them out (not giving me any options to switch the loan to another company). Their customer service reps are rude, uncaring, unresponsive, etc. And that's if you can get to one since their automated system is next to impossible to navigate. There are fees assessed that there are no rhyme or reason for and when you ask about them, you get a song and dance.
They call at all hours of the day from 87 different phone numbers if you are even an hour late making the payment. I am currently behind on the loan and tried to make the complete payment today and their credit card processing, both on the web and when you call, are down, so I chatted with two different people through their live chat and one rep over the phone that were of no help whatsoever. These people shouldn't be allowed to take care of pet rocks let alone people’s loans. Stay away from Santander Consumer! Does anyone know of a class action suit against them in NY? If so, I would like to join!

I financed my 2007 Ford truck with Citi Financial in 2008. In 2011 my loan was bought by Santander. I am two months behind on my loan due to financial hardship. I am being called all day everyday at least 15 to 20 times a day. They have added on unexplained fees and since January I. have paid on time until October and my balance has not gone down. Most of the payments are being applied to the interest and not the principle of the loan. Can anyone help with this?

I had a car loan through CitiFinancial. Next thing I knew, this company called Santander started to call me threatening they were going to take my vehicle. I was confused. I told them I talked to CitiFinancial last week and they gave me a deferment. This company told me that they don't honor CitiFinancial’s deferments and that I owe them over $1000.00 by tomorrow or they would take my vehicle! Next thing I knew I was to call this number and pay it off with my credit card. I went to the bank to deposit my payroll check, and when I was gone from work, this guy showed up and told my employer that he was there to pick up my vehicle.
So, of course I immediately called the number they gave me, sent the money from my credit card, and I asked if they could email me or fax me a receipt. They told me no! The next day I called to check out my balance on my loan (they at least gave me a number to do that). I found out the $1000.00 I gave them was never recorded and there was an additional $5000.00 on my balance! So guess what! Yes, I didn't make my next payment until someone could explain to me what was going on. I got a call and they told me I had a warrant out for my arrest! I haven't even received anything even stating that fact, let alone any monthly statements from this company about my loan.

In the beginning of October 2011, I requested a 2-month deferment on my auto loan payments due to some financial problems. I was denied for insufficient reason and that it was a business decision. I persisted. Eventually, on October 19, 2011, I talked to someone who advised me I could apply for T.R.I.P. I requested the paperwork and was told it would be emailed. Since that time, I have been regularly requesting the documents be emailed and/or faxed to me. I was informed that the documents could not be mailed to me through the regular post office mail.
I spoke to Linda ** on October 28 and was assured the documents had been emailed but they would be resent. At that time, Ms. Linda ** advised me that the T.R.I.P. request had been approved and the first payment of $361.06 was due on November 1, 2011. I sent the payment as instructed and awaited the arrival of the paperwork, which never came either to my inbox, spam folder or fax machine. I went to the online chat and requested the documents again and was assured they would be re-sent.
I sent the December payment of $361.06 as Ms. Linda ** had instructed me in October. Still no paperwork in my inbox, spam folder or fax. Again, I called and spoke to Cedric ** who gave me his direct line and assured me he would personally follow the process to make sure the documents were emailed to me. I still don’t have the paperwork.
On November 30, 2011, I sent a message to customer service requesting the paperwork again. On December 2, 2011, I received an email from Carlos ** advising me that the documents had been re-sent by email. Still no paperwork in my inbox, spam folder or fax.
I still don’t have those documents. I am paying as instructed by Linda **, yet my account shows that my payments are late and you continue to charge me late fees.

I had CitiFinancial and they sold my account to Santander approximately 2 years ago. I have since received my registration for the last 2 years which still lists CitiFinancial as the lien holder. I spoke to CA DMV today and I was informed that Santander is not listed as the lien holder nor is it listed as one of the thousands of financial institutions on the DMV's list of lien holders. I was told that my last lien holder on my car was 9/2008 CitiFinancial. I was told that by law Santander was required to report that they were my lien holder within 10 business days of taking over the lien from Citi. I will be filing formal complaints with DMV, Consumer Affairs, Better Business Bureau, and State Attorney's Office of CA. At the end of my loan, how can they then issue me title when they do not have the title?

This finance company, if that's what you would even call them, don't even deserve the 1 star but there was no option to not give them any stars! We originally had our vehicle loan financed with Drive Financial until they sold out to Santander. God forbid that your payment is not made on or before the due date because they will start calling the day the payment is due and they call repeatedly from different numbers starting at 7:00 am and sometimes continuing until 11:00 pm - 12:00 am. My husband works third shift and sleeps during the day and he, unfortunately, has to turn his ringer off or his phone off because of them calling repeatedly all day. This is inconvenient and hard for us at this time being we just relocated from TN to VA after the major tire company my husband worked for in western TN closed and we had to transfer with his job to VA.
As if the plant closing and job transfer wasn't stressful enough especially with the financial difficulty of it all, I called Santander to explain the situation as if they could care less. We had only been late before on a couple payments. This was the first time we had to have them defer a payment. But even after we thought we had them work out the situation with our car payment and they told us we were good until the following month, they still continued calling us on a daily basis repeatedly. My husband would put their number(s) on his call reject list and they would just call from different numbers.

If you are one day late, they start calling your phone two or three times a day. They use several calling services to call and many times, they do not leave a message. I go online and schedule my payments and it does not stop the calls.

I admit that I have been late with some of my payments due to my husband being out of work but I made sure to contact them to let them know the situation, with no help from them at all. I have managed to get my payments in, however. If payment is not in their hands on the due date, the calls start immediately on the day that the payment was due. On average, I receive approximately 25 calls from them a day and even though I talk to them on the call, they continue to call as if no notes were taken when I originally spoke to an agent. It's very frustrating and I can't wait to either get rid of my truck so that I don't have to deal with them any longer.

I was called 25 times in one day after my payment was due. I told the lady that the day it was due I mailed it. She told me that I can make the payment online or on the phone but there was a fee to do so. I told her I had done mailing my payment several times. I then was told that I could lose it just being one day late. I told her that there was a ten-day grace period and she told me they don't have to go buy that and to pay or be repossessed. I told her that was not the way things work and I was informed to buy her, I need to pay or else, I told her that I did again. She said she knows. I also told her not to call and tell that it was ten days late. They continued to call several times a day.

Santander USA Bank has been the absolute worst bank I have ever been involved with. Ever since 2008 or 2009 when they bought my auto loan from Sovereign Bank, they have been utterly ridiculous in their customer service. I have never had any issues with my auto finance companies in the past. And when my loan came to them, my account was in great standing. I never missed a payment and always paid more than my balance due. Just recently in December of 2010, I had some financial hardships and on a few occasions reached out to them for payment assistance. Each time, they would turn me down without even considering making arrangements to assist me.
I had been late on sending in a payment a couple of times and they treated me like a criminal because of it. The late fees that I have incurred since that month have been insane. They will not work with me under any circumstances and not only that; from falling behind 1 month, I received harassing automated phone calls. And still to this day, they call no less than 15 times each day. Even on the weekends and late at night, I'm getting calls from them. On top of the ridiculous customer "no service", in order to make a payment online or via phone, the fee is $10.00. That’s outrageous! I am a great consumer and I have never had an issue with any other company. Once I read the article on msn.com, I realized that I am not the only consumer receiving this type of treatment. I should have filed a complaint against Santander 2 years ago. I have a record of every call they have made to my cell phone and to my place of work. I am willing to take part in any action against them.

My original loan was purchased by Santander. Admittedly, I have had issues that have caused my payments to be late and at one point, I had to defer payments due to my mother’s poor health and expenses caring for her.

I purchased a 2004 Hemi Dodge Ram 1500 4x4 Quad Cab a few years ago. It was financed through CitiFinancial which ended up being sold to Santander shortly after. Ever since then, I have experienced nothing but pure hell from this company from their customer service, their "unethical" business tactics, and flat out lying about my account and my payments. The last straw for me was on November 30, 2011 when I received a call from one of their associates. I was told that I could make an interest payment of $369.00 plus a "service fee" of $10.95 and it would bring my account up to date. I made it very clear that they could pull it out of my account no earlier than December 2nd or the 3rd. She said that's what they would do.
What they did was pull it out immediately causing me an NSF fund. I called immediately and was told that they would refund my $35.00 NSF fee if I faxed them proof that it was charged to me, which I did. I was told I would have that refund within 24 hours after doing so. It's been almost a week now. When I called, I was told a supervisor would call me back which never happened! If you're late just one day, they will call you all day long and I mean all day every day! I inquired about my payments and I learned that they somehow have managed to tack on eight, eight deferred payments which never happened! So instead of being done with my payments after my next 15 payments, they tell me I will still owe another $7,000.00 plus!
This company is a pure scam. I would like to know why the Consumer Affairs office hasn't done anything about it. Is this just a forum for all of us to post and vent our frustrations, or is the Consumer Affairs going to do something about Santander and their practices of ripping off the American consumer? There are more than enough complaints here alone to justify a class action lawsuit against this company. Come on CA, do something please!

I bought a 2000 Mercury Cougar in December 2005 for my daughter. I financed the loan through Citi-Financial for 60 months. Payments were set up for auto draft from my bank and were never late. In January 2007, Citi-Financial sold the loan to Santander Consumer USA and I made arrangements with them for the same payment method. According to my payment history on their website, the February 2007 payment was 8 days late and a fee of $9.19 was assessed. How can I be assessed a late fee for a payment that was automatically drafted from my bank account?
The remaining payments were credited properly until I changed banks in March of 2011. Upon changing my bank account information, Santander drafted not one but two payments for the month of March 2011. When I contacted their "customer service" department I was told they could not correct "their mistake" and would not attempt to. As best as I could understand the broken English spoken by the "representative," I asked if the April 2011 payment would still be automatically drafted from my bank account on April 1st 2011 and was told that it would be unless I canceled the auto draft which could only be done on their on line account website.
I promptly canceled the auto draft and did not make a payment in April 2011 because it had been made in March. From March through December 2011, I either mailed the payment or paid the outrageous fee of $10.95 to make the payment through their online website. The May through October payments were late but never over 15 days late. I made payment number 60 on December 1, 2011. Their records indicate I have a balance of $281.38 for interest accrued at $0.11 per day the account is late. Now math was not my strong point but if my payment was 15 days late for 6 months, that would be 90 days at $0.11 per day would be $9.90 and not $281.38. I’m not sure what mathematical equations their using. This car should be paid in full as agreed and my title should be on the way to me. Instead, I’m being defrauded by an evidently unregulated and fraudulent company.

If I could, I would give this company a negative 100. We financed a car in May 2005 and Santander bought our loan from HSBC around 2007/2008. We had always made our car payment on time, but when Santander took over, we stopped getting statements, but we continued to make payments by phone because we didn't want to have bad credit.
When we finally got a statement six months (& 6 car payments) later, our balance was higher than it was on the last HSBC statement. I called and I was told it was for late charges and for using the phone to make payments. I explained I hadn't received a statement for months and I didn't have a mailing address and the response was a polite "that's your problem". I asked them to send me a detailed listing of the charges and debits on our account. I still have not received it and this was 3 years ago. We also did not receive a monthly statement. We would get once every once in a while.
We continued to make payments, but when I received a statement at the end of our contract showing a $3,000 balance, I called and asked what it was for and I requested a breakdown. I did not receive it. Instead, our car was repossessed to our shock.
When we called, they said that it was because there was an unpaid balance at the end of the loan and that we couldn't get the car back without paying it. So, we paid it since it is the only car we have. Also, the repossession company delayed releasing the car to us. Something really needs to be done about this. I still have not been given a breakdown of our charges even though I have requested it on a monthly basis since 2008.

Since taking over this auto loan account from Citibank, the service has plummeted! My bill is due on the 13th of each month, but my statement is never received before the 7th, affording me less than a week to plan the payment. They offer online payment, but only for a fee. They are apparently exempt from all the rules of the new Card Act, since they are secured term loan makers rather than credit card issuers. All of their rules and practices appear to be formulated to try to increase late fees on borrowers, and maximize interest, since it is simple-interest based.
I would normally pay my bill early and save substantial amounts of interest over the life of the loan but cannot, due to their billing practices. I wish someone would take this up as a class action, because I'm sure they're doing this to every one of hundreds of thousands of accounts they bought. Everyone: if you can avoid using Santander Consumer Financial to finance your next auto (or anything else), you would be wise to do so.

I have a vehicle that was with CitiFinancial. Santander took over the account in which the vehicle was entered in bankruptcy and cleared with a 0 balance. It has been written off as unsalvageable and I have been told that they do not have interest in the vehicle or retaining any monetary funds for the vehicle, but they still will not release the lien off the vehicle.

In 2005 I bought my car and was financed by CitiBank who in turn 2 years later sold my loan to Santandar.
On 10/17/11, I lost my job on 10/18/11. I contacted Santandar to advise them I had lost my job and that my November payment maybe late. I was advised that I would have to call back in November. I called back early in November to let them know my November payment would be late and was advised I had to call back again after the due date of 11/22. On 11/23 I attempted to call Santandar and could not get through to anyone just kept being routed to the Bankruptcy Department which was closed (I was calling after 5:00 pm CT).
This went on everyday until 11/30/11 when I decided to call at 7:00 am. I explained to the Customer Service Rep Adrian that I was not able to make my payment and explained I had lost my job and recently found another at a considerably less amount of pay. I requested to have my loan refinanced so that the payments would be lower. (I have been paying $310.85 a month an now have a balance of around $8,000 left due on the car). Adrian explained that Santandar does not refinance loans and since I had already had 2 deferrals and a 6 month modification lowering my payment for the 6 month period in the past 4 years, there was nothing he could do to help me.
I asked Adrian why I was unable to get a customer service representative after 5:00 pm CT on the phone even after I had emailed the Customer Service Department for hours and lodged a complaint with the OOP. I was then advised by Adrian since I had a Cease and Desist order on the account (because I received over 40 calls in one day while being reviewed for a modification on my loan) that I was not allowed to be connected to anyone after 5:00 pm.
I explained to Adrian that at no time was I ever late on a payment without first notifying Santandar and when I did notify them they were quick to defer the payment. Now, they don't want to help me at all. I asked for Supervisor and was told there wasn't one. I laughed and said let's try this again. I have worked in call centers for over 8 years including in collections and I knew there was a Supervisor I could talk to and that I wasn't hanging up until I spoke to a Supervisor. Adrian asked me to hold and a Supervisor Glenna ** came on the line. I explained the situation to Ms. Glenna and was advised there was nothing Santandar could do since it would "hurt me by helping me".
This made no sense to me whatsoever. I asked how can helping me hurt me? Ms. Glenna advised that I had been helped enough and by helping me again would not allow me to pay off the loan. I said, so repossessing the car will help me out and get your loan paid? She said yes and what you don't pay will be garnished from your wages. I said well good luck with that since I live in the state of Texas and Texas laws states garnishment is not permitted by any agency other than the IRS for taxes or by someone attempting to gain Child Support of which Santandar is neither. Ms. Glenna became very quiet. I again asked for assistance and was refused in a rude and curt manner.
I asked when the car was going to be repossessed and was unable to obtain a date. I stated the call was pointless and hung up.
I do not have the money for an attorney and would love to know if there is anyone involved in a class action law suit against Santandar that has the attorney's contact information. If so, please let me know.
Also, this company does not deserve a one star. It deserves zero stars. They are crooks!

They're only getting a 1 because it wouldn't let me make any negatives. Santander is the worst car loan place ever. I had great service with CitiFinancial and they worked with me on my payments and had great customer service. Then it was sold to Santander and have had the worst service ever. They call non-stop multiple times every day, including Sundays from 7:30am-8:30pm from many different numbers. When they call, they hang up after 1 ring and they do not work with me on payments or want to hear why I'm having a difficult time making my payments. They keep adding more 'charges' to my account, which I think are bogus. They start calling if they don't receive my payment by 5pm on the day it's due. They are rude and don't care about anything except getting their money. I am very angry and upset with Santander. I will never ever recommend this company to anyone!

We did a modification of our auto loan in August 2010 which was offered to us by Santander. Since the balance on the loan never seems to go down, I got out the modification paperwork and we went down to 9.99% interest, (from 12.69%), so I thought I would call and see if they could drop it down to 7% like our local bank was offering. (We cannot refinance locally because the vehicle is worth only half of what we owe, thanks Ford). The operator said the interest is 12.69% and they see nothing about a modification, after getting disconnected and calling back, this operator found the modification but said it was only to lower the payment. So I had to fax them the documents we signed and wait 3 days and call them back. Is there any way to figure how much interest they have overcharged us? Is there a lawsuit ongoing that relates to this situation? I will post again after I call them tomorrow.

When I first got my truck the loan was with Citi, two weeks later, I was notified that Drive ** was who had my loan. They will start calling me if my payment is a week late. They call my workplace and are very rude to the people who answer phones there. I have discussed my payments with them and 2 to 4 hours later, someone else will call me. This is never ending, I have received calls on Sunday as well. I have asked them to stop calling my work place as it is starting to cause me problems and now they only call me on my work cell phone.
I am sick of this. I was pushed into this loan to start with, due to auto sales tactics. It does me no good to speak to management or the company about this. Also, I have paid in the last three years and what they say it still adds up to much more then the original loan amount. I was told that I could refinance this loan after making payments on time for 18 months. Now I am being told they don't even offer refinancing. I am ready to do what needs to be done to resolve this. And I agree, they do not even deserve the 1 star you have to select to post.

Vehicle Repossessed 11/23/2011, two men from Precision Recovery, Inc arrived about 10 pm though I objected the men stated they had an order to cure my vehicle and that's what they were going to do.
I requested to get personal belongings, the men agreed but stated I had to give them the key first. After I went inside to get coat and keys, one of the men stated he phoned his supervisor and needed to see the notice I had received from Santander Consumer USA. When I went back in to get the notice, one man drove off in the tow truck and the other in my car. Precision Recovery Inc is in violation for Breach of Peace, violation of IL Commercial Code, IL Consumer Fraud Act and Fair Debt Collection Practices Act. Santander Consumer USA is contracted with the national company Renaissance Resolution Recovery and the national company is contracted with Precision Recovery, Inc. All three companies are liable for the wrongful repossession.

This company should not be in business! The only reason I gave them one star is so I could write this. My original loan was with CitiFinancial and was sold to this horrible company! I have never made a late payment and always pay more than what is due. The loan matured on 11/16/2011, yet I am being told I owe $2100.00. I spoke with four different people from Santander today and received four different payoff amounts. I am in the middle of buying a house and cannot have this horrible company report me as late to the credit bureau, so I tried to pay the vehicle off over the phone. However, they will not allow you to pay over the phone. This ripoff company wanted me to send it Western Union. It sounds like a big scam to me! I will be contacting a lawyer today!

My husband and I recently purchased a truck with the help of Santanders Financing. Unfortunately, our experience with this company upon signing our loan papers has been far from pleasant or professional. On or around September 19th, I realized that I had received no communication from Santander and that our payment was due on October 1st. I searched the Santander website for some type of phone number or email address that I could contact to resolve this issue but the only information I found was the Contact Us link. I sent an email and checked back within a few hours to see if there was a response. Nothing came.
On September 28th, I sent another email to the Contact Us link (knowing that my payment was due within a few days). It was not until October 12th (again, noting that my payment was due on OCTOBER 1st) that I finally received a response. At this time, I confirmed that my address and telephone numbers that were in Santanders possession upon signing our contract were, in fact, correct! The response to my email did include a telephone number so I proceeded to call the customer service department.
At this point, I still did not have an account number with which to make inquiries. Unfortunately, without the account number, the automated service is impossible to navigate (I'm sorry that account number does not match our records. Please re-enter the account number). I made several attempts to contact the customer support number provided and still had not received a statement or a payment book.
Finally, within a few days (on or around October 12th), I received a phone call from Santander. Unfortunately, it was not a call to resolve the lack of communication. It was a demand for immediate payment. How am I supposed to make a payment when I have no information with which to make said payment?
I told the customer care rep that I do not have an account number and was informed that he was unable to provide me with the information over the phone. However, he expected me to just hand him my social security number with no information given in return (even if you confirm the account information, I cannot give you the account number for security reasons). Each time I call the Santander customer support number, I am informed that I must make an immediate payment and that I am responsible for the late fees that have accrued despite still having no information with which to make a payment.
Each time I asked the CCR about my account number, I am informed that they are unable to give that information over the phone and that it is in my statement (the statement I still had yet to see). Each time I called, I requested to speak to a supervisor and was told that I cannot speak to a manager because Santander "has nothing like that here." I was told that I could file a "complaint" and a supervisor would get in touch with me within "24 hours." Again, this was on or around October 12th.
To this date, I never heard from a manager, supervisor or member of the accounting department, as I requested repeatedly. Likewise, when I received another immediate demand for payment, I was informed that my account was being sent to collections (despite my numerous attempts to make contact). When I requested that another complaint be filed so that someone with authority might contact me, rather than someone in another country who has no authority except to make threats, I was informed that only one complaint may be filed for each account.
When we signed the contract, we were informed that our interest rate was going to be over 22%. We were okay with this at the time because we needed the vehicle. However, on top of the 22% interest rate, we later discovered (in late October when we finally had the information needed to make a payment) that each and every time we make a payment, we are charged an additional $10.95 minimum (depending upon the form of each payment; i.e. phone, internet or mail). This means that on top of our unnaturally high interest rate, we are expected to pay a minimum of $720 over the life of our loan just to make the payments! When I finally managed to make a payment to Santander, the internet site was particularly confusing and extremely frustrating to navigate.
Out of the numerous requests we made to have a statement or payment book sent to our residence, the first statement that was actually sent out was postdated for October 21st! As soon as we received the statement, we made our first payment and were charged $10.95 to do so. I have no intention of paying the $30 in late fees for something that is completely out of my control. Let me reiterate that I made numerous attempts to contact Santander with no return contact made. I will not make a payment to someone in another country especially if they are willing to take my money and social security number but won't give me my account number. I understand the security reasons but security goes both ways.
Since making that first payment, both my husband and I have received very harassing telephone calls from Santander customer service. We are contacted every hour to demand that we make immediate payment. My husband and I counted the number of times we have been called and between the two of us, there has been as many as 26 calls from Santander in one day. Our lack of payment is on the part of Santander and was completely out of our control. If we had been sent the statement back in August when we signed our contract or even in September when I made the first contact, this would never have become an issue.

Rating is -10. We financed a 2004 Nissan Maxima SE with Citi Auto Finance in 2008 and they were the best of people! We couldn't have asked for a more understanding group of people. But the day came where I got a letter in the mail saying that Santander Consumer USA had bought out our account from Citi Auto. From that moment on, we had nothing but hell with these people. First off, I am not racist but I could never seem to get a person on the phone that spoke clear and understandable English. In the course of a year (from 2009-2010), my husband was diagnosed with cancer and had to go on extended sick leave from his job without pay.
I had the stress of working and being a full time wife and mother to two young girls. I called them to let them know that I may be behind, they didn't care. They wanted to payment right then and even threatened me in a polite way, if there is such a thing as that. I refused and told them that they would get the payment a week late and that's all there was to it. Within a month, I was hospitalized and had to have multiple surgeries and I have no health insurance. After being off with no pay for 8 weeks, I finally returned to work and after 4 years of working there, I was terminated. I found another job, for less pay of course, within a week of being terminated. They held my first check so I didn't get paid for a month.
I called to advice them that I was going to be late again and again they were demanding and very rude. They did not want to hear my "excuses" so they said. Shortly after that incident, we had to spend $4,763.83 (that's with a warranty) in repairing the car because of all the issues with it. Within a couple of weeks, we had to take it back to the shop 4 more times (totaling another $2,700). We got behind again, but got it all caught up in the end. I was laid off from my new job because the company went under and tried to get unemployment. Not but 3 days after me losing my job, the car was destroyed by an electrical fire in the navigation. The navigation is one thing that went out and we did not fix because that would have been another $1,490 because our warranty didn't cover that either.
That fire happened on 8-12-11, and our insurance and GAP covered most of the car, except all the late fees and other ** that they said they had imposed even though the account was current (15 days before payment was due) at this time. Now because I told them I refuse to pay the late fees because we had it caught up and have proof, they want to send me a letter saying they are going to repossess the car. Ha! The car was melted to ground. I still continue to get harassing phone calls and letters. I can't afford to get an attorney or lawyer, so I just told them to come repossess the license plate and door handle we happened to save. This company is nothing but a bunch of heartless, cold blooded and outsourced thieves!

When I originally took out my car loan, I was dealing with Road Loans/Triad Financial. They were very nice from day 1 and worked with me. First loan payment was made in Septemeber 2006. Before the actual due date, $365.21/month payments were made. When I had a financial setback in 2007, they happily refinanced me to make lower payments. Then in 2008, Santander took them over. I continued to make payments.
In 2010 (to 2011) I had over $3000 in out-of-pocket medical expenses. Then I had to shell out $409 for new glasses and $538 for dental (my insurance didn't cover all expenses 100%). My mother died in October 2010 and with her death, I lost my income as a caregiver. So I am living on SSA and unemployment. I contacted Santander about it. They brought up my bankruptcy (had to file that due to embezzlement by the Johnson Law Group who themselves filed chapter 7). I contacted Phillips-Webster Law Office in Seattle and they advised me to file bankruptcy; I had to, I had no other choice.
I had to list car loan by law, but opted to retain the vehicle. However, every time I called Santander, they threw the bankruptcy in my face. I finally told them, "My bankruptcy discharge did not include my car loan. What part of that don't you understand?". I am 5 payments behind. I asked them to refinance the loan. "We don't refinance our own loans", they said, which is a crock. Triad Financial did that for me! I had printed out my payment history from the start (63 payments totaling $20,567.18) and faxed it to Santander (the number Mr. ** gave me when I talked to him on Saturday). He has not called me to confirm receipt of my records. They told me I had to pay $1521 to catch the loan up - else they would repossess my car.
I told them that it's not cost-effective for them to do that because my car is nearly 10 years old and has over 88K miles on it. I need my vehicle for transporting myself to my doctor appointments all over the place, shopping; and some measure of independence! I am 69 and will be 70 years old in 4 months. I told them that the economy is tough all over - people with no jobs. I have been jobless for a year now; people losing homes to foreclosure. I told them it was to their benefit to work with me. They are nothing more than cancerous leeches! I can't afford to hire a lawyer.

Santander took over my loan I think about a year ago and I called them to ask them to work with me because I was getting behind on my loan and they said no. so for a year I've been one month behind and just kept sending them what i could and they call several times a day and harass me. I just lost my job a few weeks ago and I asked them if they would work with me and they said no. I can never speak to anyone who can actually do anything, they just keep saying they will submit my request and it's up to management to approve it which they keep denying my request help. I only owe about $1800 on the car and they are refusing to help me after I lost my job. Do not use this company. They are rapist.

Rating a zero!! This company is a joke I had nothing but trouble since my loan was sold to this company by Citifinacial. I mailed my last truck payment like I was told on 11-10-11 to the address they told me to send to since I couldn't make it over the phone like I normally do. My check cleared on Thursday 11-17-11 but now all the sudden they said they never received this payment? I had to get proof this check cleared my account and its been a run around since yesterday. I have contacted the JP Morgan Chase bank that's stamped on the back of check this morning about this matter and Santander does deal with this bank but I was told on the phone yesterday by who ever I talked to from Santander that they don't deal with this bank? Well I guess that person was wrong from Santander.
This company needs to get employees that know how to speak English and knows what they are talking about instead of giving false information every time I call. They told me it will take 72 hrs to find out where my money is. And if they can't find it I will have to send another payment for this amount ? I am sorry to say but that's not going to happen. Also I was told by this very rude employee from Santander that I have no reason to be upset about this? Hello, this is my money we are talking about not theirs. I have contacted the BBB about this and if this matter isn't resolved by Monday morning, I have decided to seek legal action. I have had nothing but problems with this company from the harassing phone calls for being one day late. They have called my cell phone all day long while I am at work and house phone all night long bothering my family. I just want to done with these people and this company needs to be closed down for a number of reasons. I am very unhappy and frustrated with this company. I feel they stole my money so they can get more money out of me from the daily interest occurring during the time they are trying to find my money.

Yes, there is something we all can do, that is to put God first. He didn't bring us this far to leave us. I posted a comment 11-9-11 regarding Santander Consumer USA Inc. I've experienced Santander Consumer USA's fraudulent, manipulative, shrewd way of conducting business. It's morally wrong, and unacceptable. We, as consumers, need to take a stand for our rights. I submitted a complaint to Consumer Affairs, and BBB, not knowing that there were 143 complaints against this company.
I had a gut feeling that there were others going through the same situation. On November 17,2011, I spoke to an Attorney Paul **. he has accepted my case against Santander Consumer. I also asked if he does class action suits. He stated his partner handles them. Their number is **. I feel this was God sent. I started reading the complaints from other consumers. I instantly felt I'm in this situation for a reason!
I filed a complaint with the County Of Los Angeles Consumers Department. They will be forwarding my paperwork to the regulators that oversee repo agents. I read Hallmon of San Antonio, Texas comment,"I'm serious, let's get the ball rolling". In the mean time, we need some news coverage, and send letters to the local news channels, certify them with return receipt. Also, LA Times has a reporter Sandy **. Here's her address Los Angeles Times, ** Los Angeles, CA 90012-4105. Let's bombard her with letters.

I recently mailed in my last payment via mail, because I wasn't allowed to make my last payment over the phone by their rules. They received payment and debited out of my account on Thursday, 11/17/2011. As of yesterday, my payment wasn't made to my account. I called and they said they never received my payment, in which I have a copy of my check from my bank that they did. I sent my payment and they said this is my fault. How is it my fault? They are the ones that processed my payment, not me, also the bank on the back of the check who cashed it.
Santander says they don't deal with this bank. How is this possible? Now my account is under review because of this missing payment. Not only am I very upset because of their screw up, but my account is incurring interest daily which they will accept me to pay. I refuse to pay any more money to these people. They don't know how to do their jobs. It's very obvious. And they need to get people that can speak English. Half the time I can't understand them. I had nothing but problems with this company since they bought my loan from CitiFinancial.

I cannot add anything new to this forum. Mr. ** was more than rude. He was threatening. And what really made me angry was that I couldn't get to his throat to strangle him. I am behind on my car payments and I am making 2 payments a month to catch up. But like someone else said, they only apply your payments to the interest. Certainly this company made excessive auto dial calls to my cell while payments were behind. I also suspect inappropriate excessive charges were applied during the loan. The loan was paid off 10/21/11 by my insurance co due to a total loss claim. Santander sent the title immediately but continues to withhold the overpayment in excess of $2k over 30 days now and ignored my demand for prompt payment.

Based on my experience with Santander, they have violated the Fair Debt Collection Practices Act. I also believe, based on the outrageous manner in which they charge fees, that Santander has breached the contract agreement.
The original date of the loan is 02/2008, with an original balance owed of $21,049. To date, 38 payments in the amount of $468 monthly for a total of $17,784 have been paid. Currently, the balance owed is $15,065. How could that be possible. It appears, that the bulk of the $468 is applied to interest, instead of the principal. Ex: 11/11 paid $469 and 100% of it was applied to interest! This practice has occurred on about 50% of the payments. Your assistance is greatly appreciated to help stop this company from this unfair practice. I can supply a run sheet of the payment history as well.

We purchased a vehicle in Nov 2006. It was financed through Citibank. Citibank sold the loan to Santander consumer several years ago. I have had nothing but problems since then. Santander consumer is a predatory lender. We were not informed that when a payment is due on the 1st of the month, they start charging excessive interest on the 2nd. They did not not even let us know the back interest was adding up. We continued to make payments as usual. Unknown to us, the loan has been adding surcharges for almost five years.
Now when I check into paying off the loan I find that they are trying to extort $2,000 more than I owe because of back fees they never informed me of. I have tried talking to them. However, they will not work with us. They demand full payment, and worst of all, every time I speak to them, they read the debt collection routine over the phone. I have contacted my Congressman about investigating the predatory practices of Santander consumer and the practice of reselling loans to these third party criminals. I accepted the loan because it was with Citibank.

I was moved over to this company from Citi-group. I've never had issues with Citi-group, if was behind, gave me time to catch up. They moved me over to this company. I never signed a contract with this company. I'm being charged, crazy interest rates and now they have my car. Never sent me notice that they are gonna take it.

My account was bought by Santander from another lender. I paid a payment to the other lender during the change over. I contacted Santander concerning that payment but the rep could not locate the payment. I called several times about the missing payment. One rep hung up on me. I already closed the account yet they are holding the payment to make a higher interest.

Someone came to my house 11/3/11 12:00 am. Cut the locks off my gate to retrieve my vehicle. There was no paperwork presented these people sprayed some solution in my dogs eyes. I made a 411 call to my local police dept. A Sgt was dispatched to my residence. He stated the police should have not been involved in this matter this is a civil matter. I was not aware of any repossession. I sent a car payment per agreement with my lender 9/29/11.

I have fallen behind in my payments, but I am paying them. I had direct withdrawals coming out for September 2011 and was informed to call back by the 24th to make a due date change and there will be no problems as long as a payment is made. I called back and was unable to make a due date change because I was over my 28days for being late. So this means that, I am 1 month behind which I have informed the rep of this. I received a call on November 4, 2011 around 7:15 pm. Was asked if I could make a payment.
I informed him that a payment just came out and I don't get paid until Nov 14, and I can make a payment then. He said well you will be 2 months behind by then. Then he asked what happened that I can't make my payments. I informed him that I recently divorce in April 2011. I was awarded the vehicle and its been hard keeping up. He said let me see what I can do. He said, well, since you just paid October 29th 2011, we can change your due date to November 24th, put your October payment at the end of the load and this will bring you current. Maturity date will be January 15, 2016 and on November 24th you will need to pay $459.76. I said okay and thank you very much this will help out a lot.
So today, November 7, 2011, I received a call stating I am 34 days behind and may be reported and 07 Jeep Commander may be repossessed. I informed her I thought this was taken care of and it I see it hasn't. She became loud and said, well your payment is due and you need to pay it. I asked to speak with a manager. Michelle ** is the supervisor that got on the phone. I explained everything to her and states the same as all other reps that called. Make a payment we will be able to change the due date and there should be no problems. So now by November 14, I will be about 42 days late in payment and she doesn't know what the status of the repo will be. Santander is very shady. I wish I had Citifinancial back. I never experienced a problem with them at all. Santander just keep you going in a circle and you will get nowhere but more phone calls.

I have made five requests not to be contacted at my place of employment. Last Friday, this company contacted me seven times within five minutes at my job. I returned the call on my lunch hour and the Santander representative was very rude and disrespectful. I would not recommend this company to anyone. Unless you're up for dealing with uneducated, unprofessional, and highly aggressive collection agents, do business elsewhere.

I’ve been making payments to United Auto Credit. Somehow they sold it to Santander. I had a heart attack less than 2 years ago. I still have complications due to it. I still work and try to make my payments on time. I got 2 months behind and called to make arrangements to catch it up. A woman told me about a payment reduction and she would email me the paperwork. A week later, I still got no paperwork so I called them. At that point, a manager told me I could get one. I’ve used all my extension due to my heart attack. And I made more than a full payment last month.
I told the rep that I would make a payment on the 8th of this month. But I got a surprise this morning. There was no truck in the driveway. I called them and they said I was still 83 days past due. That’s not true. So now I can’t go to work. I don’t know what to do. They want me to pay $1685 to get it back. I think that it’s winter time and I had a 99 Chevy Tahoe 4x4. They will get more in auction. But what sucks is that when I called them this morning, they said they had no record of the payment and of me making arrangements to get it caught up. There must be something all of us can do. Please help me figure it out.

July of 2005, I bought a new Jeep Wrangler. Financed through Citifinancial and had no problems, occasionally late, but always paid. Santander bought out my loan about a year ago and it's been a nightmare ever since. These people are idiots. My load matured July 2011, and I made an extra payment because I was offered to skip a payment in December and I did. Now all of a sudden, I'm getting calls about a $2,700 balance. How do I pay 440. a month for 6 years and still owe anything. I've paid almost $9600 in interest alone.
They have now sent me a re-modification load for the remaining "balance" but won't send me a break down of how that $2700 accumulated and what it's actually owed for. These people are somehow taking advantage of me knowing/hoping that I won't seek legal advice, but I really need help. I need this Jeep to be paid off and I don't even care about my credit rating, I just don't want them to repossess a car that should have been paid off to begin with. How can they do this? There's no way I owe that much after 6 years. Someone needs to go all out and do an investigation. All the people complaining here can't be wrong! They definitely don't deserve the one star that I gave them. But it won't let me submit unless I give it to them.

Zero stars. They are applying all of my payment to interest - nothing to principal if not paid by the due date. At the end of the loan, I will still owe them thousands of dollars. They also told me that I had to be 3 payments ahead before they would apply any extra payments to principal. If your payment is due on the first, they start calling 10 times a day, everyday!

I financed a 2004 GMC Denali-v8 in 2008 for $29,500. As of this date, I still owe $21,892.83. That is the pay off. I tried to refinance the truck and found out they charge $11.40 daily for interest. At this rate, I will never pay off this truck. I really need advice on this matter. Thanks.

Dealing with this company has been nothing short of a nightmare. I had financed a car with Drive (now Santander) after coming out of bankruptcy. The interest is extremely high and although I have paid over $9,000 on the vehicle since I purchased it, my account shows that I have only paid a little over a hundred. I will admit that I have had some setbacks which affected this account (cancer, work slow down) but I have worked very hard to get this account current again. They continually harass me by calling sometimes as many as eight times a day while I'm at work, even calling my cell phone after I requested they didn't. It doesn't take a genius to know that most people who are at work won't be able to, and shouldn't have to discuss their personal business. But they continue to call, even though the account is not 30 days late. I recently set up a direct debit from my account and still received a call from them this morning. Can someone please help?

I bought my 2008 Cobalt in May 2008. I had lousy credit due to a divorce and so the dealership set up my original loan through Drive Financial Services. It was subsequently sold to Santander. What a nightmare. I will freely admit that I did miss two car payments, but I have been on time for over two years (you'll read why in the next paragraph). Those two payments that were missed were not my fault. I sent checks to Santander for both payments a full ten days before the payment was due, and my checks were cashed late. They had the nerve to call and ask why my payments were late, and the dates on the checks were clearly written way before both payments were due.
After that fiasco, I contacted them and asked if I could use electronic bill pay through my bank. The woman I spoke with gave me quite the run around and tried to sell me their own electronic bill pay for just an additional $12.95 a month. I told her, "Look, you're already killing me with the payment and super high interest rate, and now, you want more money?" I finally said, "Listen lady, do you take electronic bank payments or not?" She got all huffy and said, "Yes," and I hung up on her. Since that day, my payment comes out of my bank electronically on the due date and the funny thing is, once you're caught up, you don't hear from them. What a miracle.
As mentioned earlier, I'd gone through a divorce and since I was the one with good credit, all the credit cards were in my name. That was a big mistake, and I've since learned my lesson. I went through a bankruptcy in March and was discharged in May 2011. Life has been a lot easier. It may seem like the cheap way out, but I haven't had a raise since May 2005 (and believe me, I am incredibly thankful that I get a paycheck every two weeks). I've got this Manila envelope at home with all of my bankruptcy paperwork in it, including my discharge. Santander's reaffirmation paperwork is in there too. Would you believe that they claim they never received my reaffirmation agreement paperwork? Surprise!
I haven't received a statement from them since I filed in March 2011 since I'm still considered under bankruptcy. I can't log onto their website, so every month when the payment clears my bank, I call them, ask for the name of the person I'm speaking with, and get the current principal balance along with the payoff balance. The last time, I spoke with Paula, and she told me she'd send me a copy of my payments (I wanted a printed copy from them, not my bank). It's been two months and still, no copy. What a shocker.
With the bankruptcy, they told me my attorney would have to reopen my case and resubmit the paperwork to get a second copy of the reaffirmation sent to them. The cost to reopen my case was $350.00. My attorney told me to just keep making payments. I worry about what will happen when I attempt to pay the loan off when the time comes. Everything I've read has been nothing but a horror story, and I worry that even with the payoff information (if it even arrives) that they'll send the repo man after my car anyway. I think it's funny that when you Google Santander Consumer USA, one of the top words that pops up without another keystroke is complaints.

My loan was originally through CitiFinancial Auto. We had no problems through them. I have to admit that we weren't always on time with the payments, but we always made them before they were more than a couple weeks late. Apparently, Santander bought the loan or whatever. We never got any information from CitiFinancial, saying they had sold the loan. For the first few weeks, we had no idea who Santander was and why they thought we owed them money. I digress.
After figuring out that they now owned the loan, we began paying Santander. Our loan was scheduled to mature on August 14, 2011. Santander says we still owe them over four thousand dollars? How? I don't know. They did tell us that we could modify the loan for the remainder. We were told by a service representative that an email would be sent to us with the necessary paperwork. This was over a month ago.
My wife and I have talked to them at least three times a week, but still no paperwork. I have given them two separate email addresses - nothing. I am at the point where I am sending a daily email from two email accounts, complaining about this situation. Every time we speak to a representative, they promise that they will handle it. I feel like they are pulling a smoke screen just to have an excuse to either deny us a modification or repossess the vehicle, which should be almost paid off. I am very, very frustrated with this company. I only wish to finish my loan and be done with Santander! I am going to seek legal counsel on this matter.

They charge $10.95 to pay your loan via Internet or phone! They never billed me on the Internet for a bogus $44 last payment on our car loan though they claim to have sent a bill to our address. It showed a zero balance on the Internet. I found out about this amount upon obtaining a credit report a month later. They refused to take it off my credit report, and put me in for another late payment which I have proof of payment on time. Why would I ruin my credit after four years of paying $315 on time, but not pay a bogus final payment of $44? Don't do business with these people.

Santander bought my auto loan from Citifinancial. I had a simple interest loan until Santander took over the loan. They use the precomputed method (Actuarial). This was done without my knowledge and without my consent. I can't pay more towards the principal each month. Santander applies the extra money to the next month's payment. I can't pay off the loan early because I'm still paying the same amount of interest. This is ridiculous. I hate Santander.

I had a car financed with this institution and it was paid off by a credit union on Aug 27, 2011. There was an overpayment of $5790 and it should be paid to me. It has been 51 days since Santander received the check to pay off the loan and I still don't have my money. The title cleared on the 6th of September and all information was verified by Santander on the 30th of September. Supposedly, a check was mailed on the 1st of October, yet no one can tell me where the money is, or are they willing to do anything else at this point. I have been told several stories as to whether or not the check was mailed and now they are telling me they have to re-verify all the information and to give it more time. I feel like I'm getting the run around because they know they can get away with it.

I rate them zero. This company should be investigated by both state and federal agencies. As you can tell all over the web, this company needs to be taken out of commission. They harass, intimidate, and steal from consumers. I paid for a Sedona Van 72 payments. The loan matured in June 2011. They say that I still owe about $535.00. That amount changes with whoever you speak to. Their website says I paid 72 payments, which is what the original contract with CitiFinancial was, before they sold the paperwork to Santander. I need my title to my van that I purchased. Santander has sent no other bills saying what this extra money is for (most likely for a company lunch party). They have no idea how to do bookkeeping. How is it they pay the U.S. taxes if their records are so messed up?
They told me it was for late charges (but a 0 was in all boxes on their bills for late charges, fees, and other). They then said that I didn't make a Dec. 2009 payment (which I did). And if that was true, then each statement after that would state that as 2 payments needed to be made (in which it doesn't). I just want my title, as I paid in full and it stated so on the last check they cashed.

I received a loan for a truck from Citibank. Somehow Santander took over the loan. Payments remained the same, but Santander added two years of payments. The truck should have been paid off by Aug 2012, now it will not be paid off until 2014. They added over $7200 to what we owe.

They're worth not even 1 star, but I had to enter something! Right now, I am going through a repossession. On Sunday morning, 2 guys showed up at my door saying they were taking my vehicle per Santander. I was late on some payments, because of unforeseen circumstances. But I was never notified by mail or anything regarding my account. I did a chapter 7 earlier in the year, and they said they couldn't communicate with me because of the BK. So I had no clue how my account was going.
They are not helpful or trying to resolve anything! They want $2862.00 by the end of the month. (That's not including the $31.00 a day at the tow yard!) Then my husband called yesterday (he's been calling them everyday), and Derek tells him, "Oh, and your regular payment is due on the 17th of the month." What? Really? He already said $2862.00 was due, and that was it! My loan is almost payed off, and that will complete it. So is someone taking a cut or what?
This company is the worst I have ever dealt with in my life! (HSBC sold the account to them.) And to top it off, I will probably lose my vehicle in the end, because there is not enough time to get that amount of money together in a short period of time, after paying on it for 5 years!

I traded in my vehicle for a newer, better gas mileage vehicle. This was in May. I received a statement from Santander in July showing payment not due till October. There had been 3 payments applied to my account. I figured my payoff on trade in was less than calculated and the overpayment was applied to new loan. I received no calls from Santander till September. They were threatening to take my car unless I pay them back to July. I tried working payments out with them to catch up their mistake in the first place. They would not budge. I asked that they not call me out at work but they do. They call my cell phone 5 to 6 times a day. I have caught payments up to current, but they sent someone to my home to take pictures. This man took pictures of my boyfriend's truck and of our home. My neighbor saw them snooping around and took pictures of them. This is to the point of major harassment and something needs to be done with this company. They do not deserve 1 star, more like negative stars.

The woman I spoke to on the phone was very rude. We have given them our new landline number but they choose not to call it. They also wanted me to give out work information. I told her that I would not give that to her, and that they need to call the new number given to them. They get nasty, when you tell them you are making the payments by MoneyGram, or money order. If my husband wasn't ill, we would have had this paid off, it doesn't make it any easier when they screw up the payment, and blame the customer.

This company will be out of business soon! In May 2011, I called Santander asking for a loan modification due to me recently being lay-off. They told me that I needed to write a letter, send a proof of income (which was unemployment checks) to them, so I did. I was then told that it would take about two weeks to hear if I was approved. After 2 weeks, I called them and I was that told it was approved. My payments would be $250 a month from $431 a month for 6 months. All I had to do is wait to receive the documents from them, so I can sign and send back, letting them know that I agree to the new loan terms. I was overjoyed! Everyday, I called asking when I will be receiving these documents. I was told that they will fax or mail it to me. After a month, I started to get nervous. I then demanded to speak to a supervisor. Someone gets on the line claiming to be a manager and I was told then "Sorry Ms your deadline has expired and you are no longer qualified for the loan modification" I asked why not? I did everything you asked me to do. She said the reason is because I never sent back the agreement documents. I say I never received them! I called everyday check your notes. Long story short, I was being scammed. Is this Legal? How can they do this type of thing to people?
After struggling to pay my car note on time on a $325, a week unemployment check. I fell behind two months. I called in a payment last month of $389 and made a payment arrangement with them that I will make another payment in two weeks for the rest, and I did. So now, I was 40 days past due, then I made other arrangement to pay on 30th to pay the remaining amount I owe. Well, on September 28 they repossessed my vehicle. When I called Santander and ask them, if did they take my car, the rep said yes, and 50 days past due. I told her that I had an arrangement to pay on the 30th, it’s only the 28. She then told me that if I pay it or not on the 30th, they still were going to take the car, because it was on the list. I was never given a notice of the repossession until after they took my car explaining their intent to sell. She told me, they didn’t have to give me notice they were planning to take it. After getting my car back, that’s when they started calling me asking when I will be able to make another payment. I told them I am not behind stop calling me. I am so sick and tired of this company. I don’t know what to do.

Be careful with your payments and this company. You'll pay what they say you owe for the month and then will turn around and tell you that you owe a completely different payment for the same month. Plus, the employees are idiots. It took Eduardo almost 15 minutes just to tell me something that was plainly shown on the website. I didn't take my loan out with Santander, I took it out with Citifinancial and I wish it would've stayed with them.

Basically, this company bought my loan from GEMB lending on 4/4/11, with only one contact with me via US postal service. Upon numerous telephone calls from myself regarding my account, they have not responded at all to my request for terms and conditions, monthly payment due dates. It has now been 5 months with no response from them, yet I have made 3 contacts (all on record) with no response.

Sovereign Santander employees are not treated right. I am an ex-employee because they fired me for overlooking an expired year on the customer's I.D. that was altered. I saw that it was done, so I thought I could do the same. The customer was to bring her new I.D. She was there twice per week, if not, every week. I used to work with the same company for ten years. In 2006, it changed to Sovereign.
Two years ago, they cut staff so for eight months, I work alone on the platform and tellers unit. Many of my days were without lunch, breaks, whatsoever. I met all my goals except this last Q2 and it was all because of the management's fault. They could have given me a warning, instead of firing me. All the employes were so overworked that it is only time before someone really gets hurt. Many of the branches have only two people working. Sometimes, I am so afraid to even go to the restroom.

This is the worst customer service I have encountered in all my years of living. I was threatened and lied to, and also, they stated that they were coming to me. They would not listen to anything I had to say regarding the vehicle that it was paid off by the dealership. All they wanted to know is if the vehicle was in our driveway, if our address was the same, if we were still working, and when could they expect payment.
They were able to cash the payoff amount without applying the credit to our account. No one seemed to care that Santander had the check and cashed it but could call us 9 times a day to argue and threaten our credit because they dropped the ball with our payment. Our dealership was on the phone with them for 4 hours, arguing with them regarding the payoff amount that was paid in full and proof that check was cashed.
I cannot rate the experience because of the unprofessionalism I've had with Santander! It is by far the worst auto finance company and it needs to be put out of business!

Why should I give them one star? They are a zero! When I first got my car, the car dealer said that CitiFinancial was looking for better clients and actually offered a good interest rate. I had always had bank financing till this point. I did not have bad credit and should never had been financed through them. I had many problems with CitiFinancial. It was a whole new world to me. I was treated like I had a bad debt from day one. They wanted payment wired or wanted $14.95 fee to pay over the phone when I was not even out of the grace period for the due date. I would get an extension and approved the extension before it was 30 days past due, but they were reporting me all the time like I was 30 days when I was not to the credit bureau.
They also keep saying I broke payment arrangements that I did not break and that was on my credit record. One time, I was about 2 weeks late on my payment and CitiFinancial sent a company out to take a picture of my car and said it was because I was late. I cried and told the 2 women who came out, "who sends out someone to take a picture of a car when it is not even 30 days past due?". I was very ill at the time and figured I would straighten it out when I got better. I was very discouraged because I would call and they would say one thing and then put something else on the credit bureau. I was very ill at the time and I felt helpless as they ruined my credit.
Then all of a sudden, I was sold to this Santander Consumer without any notifications, just a new bill, but the payments went to Drive Financial which was even more confusing. I was told I was sold because I paid my car payment late. I always called and was only a week or so late or I got an extension. We are not talking about someone who was months late! Even though they would offer extensions and then never give them, I would have to get caught up and I did!
When the account was transferred, they changed my balance to a much higher amount. I called and told them they added money to my balance and it was not correct. I even sent something in writing and they ignored it. They said it was correct and I said I wanted to talk to CitiFinancial. They said I could not and they no longer existed. I have been paying to Santander ever since, every month. I have been paying on this car for 5 years total to this point. I have, according to them, one more year to pay and I still owe $6,000 and the original note was only $12,000. I told them being a week or 2 late should not accumulate such a large balance. I have already paid over $12,000 on the car. When this was all said and done, how much will I have paid? I would just have them pick up the car if I did not fear even worse credit. I told them I wanted to hire a lawyer and after reading all the repos on this site, I am now worried that they will come and take it even if I am not behind! How can you work out something with a dishonest company?

I paid off a vehicle in November of 2010. I kept receiving phone calls saying that I owed $741.39 for "filing fees", "extended services", "late charges", or "penalties for late payments". Our account had been turned over to their "collection and recovery" department. The vehicle was paid off! These calls were harassment, rude, and lies! I did not have even one late payment!
They had our payment automatically drafted, and they reported to the 3 credit bureaus that we were seriously delinquent, and I did not have one late payment. So, in order to clear this up, we paid the $741.39, and now, they won't send us our title. They are the worst company on the planet. I will never do business with a company that uses this company. All of my vehicle purchases will be made through my credit union.

My car loan was through HSBC who turned it over to Santander. Santander continues to add interest back into the balance and in some cases have taken whole payments, applied them to interest only then added the interest back onto the balance.
I have made approximately 90 payments on a loan requiring only 72 payments causing approximately $11,000.00 in overpayment being fraudulently taken by Santander who continues to hold the title to my car. As of today, Santander still shows a payoff amount of approximately $3,600+. This needs to be rectified by releasing title and providing overage refund.

I have never heard of this company. They claimed that they bought an old loan from Triad. We had a wrecked car years ago and they said that the insurance did not pay $1,000 of it. I found out who they were by viewing my credit report. Well, first of all, I did business with another company so any contracts or agreements are between me and the former company, which is no longer in business. Does this mean that if I signed a marriage contract with someone and someone else could buy it, I would then be married to that person? This company and I have no business with one another.
They said, "Do you have a mortgage? We could get the money before you sell your mortgage." I laughed and said, "We will never sell because we are leaving this house to our children." By then, you will no longer be able to collect this incorrect false debt. Every one needs to contact every state attorneys in every state. Ask for a contract between you and this company, not you and the former company. You and the new company have made no agreements with one another.
I want this off of my credit report. I guess the best way to get their attention is to get an attorney. And if you cannot afford one, all state attorneys are very fair and hard workers. There is no doubt that they would consider both sides. They know the laws and are very good about enforcing and upholding them. The reason they are there is to help everyone. So, use them if you are being abused in any way. Do not allow someone to make you a victim of poor and false credit reporting. I am surprised at how easy companies can just slap false or inaccurate information on your credit report and hope that you will not fight back. All I can say is fight for your rights to no end and put a stop to them.

I had a loan with Citi Financial Auto and they were sold to Santander Consumer USA. My loan was paid in full before they were bought out. I have tried for weeks to get a lien release. They have given me the runaround this whole time.

I am beyond angry. I spent 20 minutes on the phone explaining to one of Santander's representatives that I am approved for a refinance (payoff) that will be completed this week, if not early next week.
Since that conversation 72 hours ago, I've had a collections call every night at dinner and tonight for extra fun, a gentleman on my porch with a delinquent letter. This after just 34 days late?
I have never been treated so badly and so reprehensibly by a company. I am intending to pay this in full this week and this is how I'm treated?
I've tried 3 times to reach someone in charge who will actually note my account that I am approved by my credit union and just need to get thru the paperwork to get their check. All they want to know is my current home phone number so they can call me every night and keep their jobs.
Isn't there some law to get these people off our phone lines and out of our lives?

My loan for my 2005 Dodge Grand Caravan was originally through Citi Financial. They apparently sold the loan to Santander.
After the 72-month loan period, I was surprised to discover that I still owed over $2,300. When I asked why, they said it was because I had 11 late payments (not missing payments, late payments). They then offered a loan modification to pay the balance. I decided to bite the bullet and cash out savings to pay off the loan. They would not accept an electronic payment or even a check by mail. They said it had to be a cashier's check or money order. I therefore sent them a cashier's check for the entire amount via the USPS and I paid the extra $5 for a receipt ($2300 is involved and I wanted verification they received the money).
They are now saying that they cannot sign for the check! I have to wait for the USPS to return the check (after 15 days) and Santander will not commit to not charging me extra fees due to the delay.

In November 2010, I purchased a vehicle through Santander. In July 2011, that vehicle was totaled. The payoff was $11,924 but the insurance company would only guarantee $10,375.
On August 3, I received a letter of deficiency. I subsequently called the company and I was told they had not received anything from the insurance company. Also that I should continue to make my monthly payments and once the money came from the insurance company, someone would be in contact with me to make arrangements to pay off the remaining debt. I was actually told they would restructure the debt to lower the payments.
I had not heard anything from the company, so today, September 21, I called them. I was informed that yes, the insurance company payment had been received along with two payments and there was an outstanding balance of $1,218. I asked if I purchased another vehicle could that be rolled into the new loan. "No" was the answer. Then I asked about restructuring the debt and was told they do not do that. I was then told I had 60 days to pay off the $1,218 or the remaining balance would be charged off.

I went to Santander's website and did a live chat. My question was: If I submitted an extra $250.00 per month by check and indicated that it was for "principal", would that be a problem?
I was told I had to make 3 payments in advance, before they would use the extra money I was submitting for principal payments. I asked them where in my contract that such is said, and Amy, the chat operator, said it doesn't say it in my contract, it is a policy of theirs. So they won't accept my extra payments, until I pay $750.00 up front in addition to my regular payment. Then anything extra sent in will be used towards principal. If it's not in my contract, how can you do it?
Santander definitely seems shady.

My ex-wife signed loan modification documents on an auto loan with Santander. I have been trying to get copies of the loan modification documents since May 2011 to determine if they were forged. Each time, I was being told that they would be mailed in 7-10 days. The last time I called, I asked for a manager immediately. I was then talked to rudely, being told that I was responsible for the loan as a co-signer and that they didn't need my signature on a modification as my ex was the primary. Something doesn't feel right because I still can't get the documents. At this point, I feel stuck.

I've been off work since 06/14/2011 on FMLA medical leave because I had surgery. I made Santander aware that I was about to have surgery and needed help with a reduced payment or something before I had surgery. I was told the only thing they could do was defer a payment for one month. I sent them what I can when I got my disability check and spread it over several other bills also. My disability check is way under what my car payment is and my rent is more than my car payment. Then there are medical bills, groceries, electricity, etc. I'm also single and have no other means of support.
I get calls several times a day both on my home phone and on my cell phone on the same day. Most times, the calls on my cell phone are right after they call my home. Then sometimes, they'll call my cell and have a number with no name on the cell but then call my home with the same number and the caller ID says Santander Consumer. I talk to them once in a while and have explained my situation over and over again, and I was told "I'll note this on your account". The next time we speak, they asked me the same questions "Why did this fall behind?". Why keep asking the same questions if you put it on file? Why don't they just look it up?
I keep telling them I sent what I could and that's all I can do as long as I'm on medical leave. They just say "well, I understand that but we need a payment and that's not enough". The calls have become harassing to me and I finally found something on the internet that said if you get harassing calls from a debt collector, to write them a letter and ask that they cease and desist all contact via phone and once that's done, they have to stop calling. Well, they haven't stopped calling and they got the letter by now. I have the name of the lawyer service who said they could stop debt collectors from calling if I need to report this to them.
I told Santander that I'd report the calls legally if it continues, in the letter, but that didn't stop them. I really am not lying about not having the money to send a regular payment until I get back to work. I've run completely out of food several times since I've been on medical leave while waiting for my disability checks and all my bills are behind. I can only do what I can. I've sold my DVDs and CDs just for gas money and/or food once. They get paid weekly, why do they think consumers get paid daily? Nothing changes overnight.

This company is a joke. You make payments to them but nothing goes to principal. They charge fees when your payments are there on time. They got a check on a payoff on a car on 8/29/11. If I don't pay it off until Sept. 7, the payoff amount will go up. Then, they are still sending me bills for a car that is paid off. I think when you pay a car off early, you shouldn't have to pay the interest for the remaining years. My car was stolen. The insurance company paid it off 2 years early. I shouldn't have to pay that. I should be reimbursed for that. This company is a ripoff. I have contacted the BBB and the Attorney General on this issue.

I stopped ACH on my Santander account in August. My bank took a July payment back from Santander without permission. It was a mistake on their part, not mine. I reported it asap to Santander. They told me they would continue to call me everyday until it was resolved. They are still calling me everyday, sometimes 5 or 6 times a day all hours. Even though it has been resolved and I am paying the payment to them on October 1, they said they will keep calling until they have the payment. My bank is faxing them a letter stating what happened. Now my current payment can only be made by mail. Otherwise, I will be charged $10.95 extra just to make my regular payment.

We purchased a car from IPac Mazda in San Antonio. We were told that our first due date was in July. We waited for paperwork for over a month, only to find out that the due date was in June. I received call after call from Santander consumer in May asking all sorts of information that had already been provided to them. The calls were over done for sure. We inquired about changing our due date in July to reflect being due on the 1st and we were told that we have to make the first payment, then the due date could be changed. The original due date was for the 22nd of every month. My husband is a disabled vet and he gets paid on the first.
On August 2nd, my husband received a call from a customer service representative from Santander. In the course of the conversation, the representative offered to have the due date changed. He was told by the representative that the best she could do was to move it up two days to the 24th. Having been told that was the best she could do, my husband agreed and let her know that we will always be late if we can't have the 1st.
We started to receive calls informing us that we were delinquent. At this point I asked for a supervisor. After a heated argument, I was told that we could never have the first and the best they could ever do is the 4th. I was like ok, I'll take it but I was told no. My husband had agreed to the 24th and they can't change it. I argued that we didn't know that we could have the 4th because the representative said that she could only do two days ahead. The call was escalated to the President's office. I was told that the recording would be pulled and I would get a call back. A month later, on September 14th 2011, we received a call back from Rhonda.
She informed me that they listened to the recording and that my husband had agreed to the 20th of every month. I disagreed, but she said that the call was clear. My husband knew what he said and so did I. I asked if we can hear the recording and was told no; we have to get a lawyer to subpoena it. I was also informed that maybe we could be able to find a way to make up the accrued interest for the payments being late. I was angry and argued for a bit but to no avail. Why would I ask for the 20th of every month if I can't pay on the 22nd?
I called back on September 14th 2011 at 12:02pm and spoke to Latoya. I asked her to send the findings for the due date incident in writing. After being put on hold for ten straight minutes with no music, she said that they can do that. I understand that it is a courtesy to change the date, but they lied and now they are calling us a liar, too.
I think a class action is in order against them for deceptive practice and misguiding the consumer. I am serious and if you are too, let's get the ball rolling. This place is a rip off. Not only did they take away two days, they are hitting for interest, too. Beware. If you go to a dealership and this is the only bank to take you, run like hell.

This company is ridiculous! Why hasn't there been a class action lawsuit filed yet?
Almost two years ago, I financed a car through them and I now owe more than what I originally borrowed. They have lost my payments, refused to send me any kind of paperwork to show where my payments are going (e.g. principal and interest). People that can barely speak English are calling me at least five times a day after speaking with three different representatives out of those five calls.
Something needs to be done about this company. I'm on a point where I'm ready to tell them to come pick up my car because I'm tired of the harassment.Somebody please put this company out of business!

My loan was purchased by Santander from Drive Financial. Santander has failed to apply payments to my account balance, failed to mail me a copy of my contract, and informed me that I had to be paid up three months in advance to pay off my loan. They say that they can apply my payments any way they want to. When I have made inquiries, I have never gotten a response. My pay off amount has not been reduced in three months. They are stealing money from me every month. I am still paying on an illegally inflated loan.

I have made several calls to Santander Consumer USA regarding vehicle auto loan over last year. My loan was bought out by them.
I have never called once that I haven't gotten rude, disrespectful customer service. I will never get a loan with them again, if I can help it. I don't know who these people are, but if my business was customer service, I would be out of business if I acted the way all of their customer service representative acts. I don't know how they stay in business. We are all human, everyone has problems, so treat people with respect, there is no reason for them to be rude to customers.

I want to start by saying I have never had an account with Santander Bank. I previously purchased a car in 1997, financed through Auto One Loan. My car loan was paid off in full in January 2005. In August 2005, Auto One's Auto Loan division was purchased by CitiBank Auto division. Moving forward, I pulled my credit report in August 2011 and found that Santander Bank was on my report showing I was 180 days behind on auto payments and owed $613.00. I immediately disputed this and contacted Santander Bank per the number listed on the credit report.
I spoke with multiple individuals explaining I have never had an account with their company and my auto loan had been paid off in full in 2005. Well, after multiple transfers and restating the entire conversation, I was told as per what was on the computer that I owed for a car loan. I am done with attempting to have reasonable, professional conversation with the customer service department of this company. I have left messages with the Office of the President of the company but no return calls yet. How dare this company add fraudulent information on my credit report!

Santander Consumer is terrible. I lost my job and tried to work out a payment plan but they were not willing to work with me. Today at 2:00AM, the repo guys showed up with paperwork to repossess my car. When I called Santander about this matter, the representative told me that they do not have to send me any notification because my state does not require that I need to be notified in writing. Well, they lied because I contacted the state Department of Justice and in the state where I live, VA, they must send me a notice 10 days prior to the repossession. I plan to hire an attorney and sue them. I also filed a complaint with the Federal Trade Commission and VA State Attorney General's office. I think that they should be under federal investigation.

My name and phone number was used by a friend as a contact/emergency number and, since she has not kept up with her payment, I am being harassed daily by numerous phone calls from different operators. I have contacted this company each time requesting that my cell phone number be taken off and each time I get a lame response on yes, I see a notation that you requested not to be contacted, but no explanation as to why I'm still getting the calls.
I have been called from seven different phone numbers and each time they have me to call the 18882224227, never the same operator. I have threatened to call the Better Business Bureau and even tried calling the police for harassment.
I am demanding that my number be removed and, because I have be getting them on my cell and not my home, I'm afraid to really put my number in this report.

Santander Consumer USA Inc. is a complete ripoff. I have had my car for 3 years and I have been making payments on time, until I fell ill and could not work anymore. I was only receiving unemployment, which was half of what my car note was. My car note was $465.53. I was given 4 deferments to help me catch up my payments but not knowing that even with the deferments I was given, I still was being put in the system as behind on those 4 payments. I started making partial payments and paying what I could, like I was told to do by several supervisors there.
My car was repossessed in April, and I was told to send a payment in for $935.00 and I would get my car back. Well, after borrowing the money from a family member, I paid that amount and Santander told that if I would have paid that amount before the repo came and got my car, I could get it back. So, they refused to release my vehicle until they received another $935.00 from me and it took to a couple of days to find another family member that would help me out. So, finally, after sending them $2,000.00, I got my car back and that was the complete amount I was late on.
Two months later, with only one payment missed, Santander say that I owe them another $2,000.00. I have had my car for almost three years with a payment of $465.53 a month and I have made a total of 20 payments. My car value as of today is $8,000.00 and Santander is saying that I owe them $20,000.00 for a $8,000.00 vehicle. I am sorry but they will never receive another penny from me, and I have filed bankruptcy to get them off my back and to stop them from harassing me. They call me non-stop from dust to dawn and even after I told them not contact me and after I have sent them bankruptcy papers, they are still contacting me. Are these people crazy or they just don't give a dam to respect someone's issues?

My auto loan was originally through HSBC. I guess they went out of business so the loan got transferred to Santander. I have experienced the worst customer service ever. None of the people in customer service or the title department seem to be on the same page. Ask five people the same question and you'll get five wildly different answers. And hardly any of them speak English. My car is now paid off and they are holding my title hostage. My husband is in the military and we are on military orders to Germany.
A local dealership agreed to buy the car and paid it off. Santander refuses to release the title. Without it, the dealer cannot pay me what they owe me for the car or resell it. This is the worst auto finance company I have ever dealt with. They claim that they are just abiding by state laws when in reality, they are just making up their own arbitrary policies. I called six random used car dealers in WA and no one has ever heard of these supposed laws Santander is making up. Now, because of them, I have to leave the country with this business of my car completely up in the air.

I received calls (rude and arrogant) about my son's account and I told them I have nothing to do with this account.
They call me day and night. I told them I would report them to consumer affairs and they stated that I couldn't do that. I wrote numerous letters of complaint but they still call. My son and his wife had the account moved to the 15th of each month but they call on the 1st through the 15th.

My original loan was with Citi in April 2006. After six months, they sold the loan to Santander. The original loan amount was $17,245.87. At this point, I have paid $28,744.53. I was late with one payment in June 2008. According to Santander and all three credit agencies, I have never otherwise paid a payment late. Yet, with only a few payments left, my payoff balance is $16,839.87. This means that out of the $28,744.53 (on time payments), only $406.00 has gone to principal. Keep in mind, I only had one late payment in five years. It is not mathematically possible to payoff my vehicle by the term end date. 99.9% of all payments have gone to interest. By the way, my APR is not 99.9% or even close. I am unable to get any answers from Santander regarding this situation. I've talked to my bank's financial manager (who has been in that position for 23 years). She said "she has never seen anything like this". She reviewed my original contract. She concluded that my balance should be approximately $4,100.00, with most of my remaining payments going to principal. She advised me to speak with an attorney regarding usury laws and fraud.

I was contacted by this company through mail about my payoff of $925.00 and its maturity. I would receive phone calls ten times a day and the staff was rude and demanding. There are 118 complaints against the company and no one has taken into consideration how they are being harassed. It's not right to anyone paying taxes and I would like this matter looked into asap.

This is regarding Santandar Consumer USA. I have made 58 payments out of my 72 payments for a 2005 Mazda 6. There is still a $13,000 balance due on the car loan. I have paid over $30,000 in payments (original amount of the loan was $22,000) so far due to high interest and finance charges. I sustained a 75% loss of income as of February 2010. I continued making payments to Santandar, although I was 60-90 days late, but they did receive a payment. They repossessed my car on 8/26/11 as they didn't want to wait any longer for their payment this month but never actually spoke with me other than leaving messages to call them. My car will be auctioned off sometime next week. I cannot pay any difference at this time due to lack of income.

Santander had my car repossessed even thought it had been paid for 2 1/2 yrs. CitiFinancial received my final payment at the same time that it was declaring bankruptcy with the federal government. I believe CitiFinancial sold my account to Santander to get money for their own debts. Santander refused to send me my clear title. I requested it at least twice in writing certified mail. On August 2011, Santander illegally repossessed my car and I have not heard anything at all from them. I called numerous times and no one will call me back. What can I do. They stole my car.

I purchased a car. I had it financed through Santander Consumer USA. At no point did I ever set up automatic e-payments from my checking account with this company. Due to economic times, I am no longer able to meet my repayment agreement. So, I wrote to them both in email and via post office that I wished to surrender the vehicle. A week after, the requests were submitted to Santander. They debited my checking account $349.49 without my authorization. And they continue to call and harass me both at work and on my cell phone from 7am to midnight (literally).

I needed to get my husband's name off because he was deceased. I also needed to get the car registration changed from VA to MD. I started the process with Santander on 6/29/11. I faxed all info to them to complete both transactions. I called on 7/13/11. They could not find the request I faxed from MVA. I faxed the request from MVA again. On 7/29/11, I called Santander. They claimed they had all info. But there was no notation on file as to where it was. They suggested that I wait a week and they would be able to tell me what was going on.
I called MVA on 8/22/11 to see what the holdup was. They had not recorded anything from Santander. I called Santander. They said they had my cover letter on file which stated that there was an attachment. But still, they did not have the request from MVA for registration. I faxed this for the third time. And again, I elicited a promise from Maricela that she would call me when it was recorded. She finally did. But she said she would send it to appropriate department and call me with the tracking number. True to the Santander way, they did not call. On 8/30/11, I called. And the information went out on 8/25/11. Finally, something was done right. I stayed in all summer waiting for this to happen.

I purchased my 2005 Chevy Malibu from Chevy and it was financed with HSBC on 05 May 2005. I was late with two payments and filed for bankruptcy on 05 October 2005. I kept the car during the bankruptcy along with my mobile home. After my bankruptcy in October 2008, I then was two months behind. On April 2009, my car was repossessed. During that time, I was in the hospital with heart problems just after having gall bladder surgery. I explained that I was in the hospital and asked them to wait for my payment when I get out. Well, while I was on the phone with HSBC, my car was being impounded. When I got out of the hospital the next day, I contacted HSBC. I wired the cash and picked up my vehicle.
Several months later, they sold the contract to Santander Consumer USA. My payments had always been on time and never late again since getting my vehicle back. Since May 2011, I stopped receiving statements from Santander. I contacted them and told them that I was not receiving my statements. I was still mailing in my payments on time knowing that my car would be paid off on 02 July 2011. Well, I found out that Santander has been charging a simple interest charge on top of my original payment and interest. So now, they are telling me that I have another $2,668.65 to pay off since my late payments with HSBC were charged this extra interest.
Well, it basically comes out that $100 was going to my payment and $433.73 was going to the interest each month. I never heard of such a thing and my statements never reflected an extra fee or charge. I can't believe this is happening. I asked for copies of the contracts and all my payments from when I was with HSBC then to Santander Consumer USA. I have yet to receive any paper work or statement to this date. I have phoned numerous times, and as of 31 August 2011, I have not yet received the paper work or a statement for September. I was told that I need to pay off the extra interest and that they use Google simple interest calculator. I told her, "You have got to be kidding me." The last year and a half, I have had gall bladder surgery, delicate spinal surgery, and was hospitalized for heart problem. This is not helping my stress level at all.

This company is charging me an outrageous amount of interest. After referring to my original contract, I saw that we have a fixed interest rate. I have asked for a loan remodification due to several lies happening and have been told that we do not qualify due to the fact that we have used up our deferments. This is not true. With this information regarding our interest rate, this loan should be remodified based on truth and principal. This country is trying to rip us off and we won't stand for that.

They took over an auto loan and called me about 10 times a day (caller ID) while I was on vacation. When we spoke, they told me that there was an additional $143.00 that I owe them. I asked from where and the person on the phone had no answer, so I requested a validation of the debt in writing--it has never come. Now, they sent me a letter stating that I owe them $304.00; however, I spoke with a representative last night and he again stated the $143.00 amount. I sent them another email requesting a validation of the debt in writing to the company today.
Their auto dealer continues to call my home and cell phone. They don't appear to want to answer my question on paper but to have me acknowledge verbally some debt that I don't believe I owe. Based on my Internet searches, this seems to be common with this company. During my discussion with their representative, I asked if they were a licensed debt collector in California. They said yes but did not provide a number.
