I called to settle a late payment, today 030707. They said they would process it and wave the next months late fee. I received a call just 20min later by another rep stating that they will not wave the fee and they where going to charge my account for 29.00. nyway $21. Then I receive a bill for about $52 minimum. So I pay it. the next month I receive a bill that states I have late charges that I need to pay because I didn't include the normal monthly payment (52 + 21).

When I called to straighten this out I was told I had to get in touch with th3 bank that the check was written on and get a reference number so Capitol one could correct this.

I've had a long relationship with them (5 years) and always have paid in full every month. They've attempted to negate my rewards points. Claimed false late fees and done just about every ridiculous thing in the book. Then when I review their supposed "loan" requirements I notice that it's now saying you've had a business card with at LEAST a 5,000 limit...they have my limit set at 3500 but yet I've done over 60,000 in business with them and another 30 through their auto loans.

I had a $4,000 loan in 2001. I Had emergency surgery in September of 2004. I was on disability for 2 months. Could not pay. The attorney made arrangements to pay when back to work. I was told instead of paying $105.00 a month, I could just pay half, about $50.00 a month. I owed $800.00 only. In between getting better in two months from Sept to November I was harassed daily up to 7 times a day even on weekends about the money. They would call at 6 a.m. PST until after 9:30 at night. I am now on Credit Foundation Consumer Debt Program. All bills including the 3 Capital One credit cards i have on the list. I paid off one Capital One credit card last year and still making payments on the other two at $30.00 a month each. For the loan payments, I was yelled at, screamed at, cussed at, Capital One made calls to my job. I wrote them to please do not call my job and they continued. The Lawyer called last month to say Cap One is suing me. I called the Lawyers (Winn & Sims in Fullerton, CA) i don't want to go to court. They refused to cooperate. I get a letter a week or two more and says that we can solve this problem.. I was informed I owe from $800.00 now over $3,700.00 from 'fees' over the last two years and court costs. I had a bonus, which I sent them in a cashier's check of $1,000.00. I am now to pay $175.00 per month till this is paid off. This was originally a $4,000.00 loan. I only owed $800.00. Cap One will not give me information on all the payments I made automatically over the years. So now I'm stuck paying $175.00 a month and.

I opened one of the mailings that said my account was changing. In the letter I found a statement that included a bill for payment protection and there was a number to call beside the company that was billing me. I called the number. Apparently Capitol One gave my credit card number to some payment protection company and they have been billing me for a service that I did not purchase. I have never signed any contract with the company, which I found out was named Stonebridge out of Plano, Texas. I spoke with a lady at the number beside the payment protection listing on my statement. I told her I didn't by any payment protection and she wanted to know if I knew what it was, I told her I didn't, she then explained it to me. I told her that I would never buy anything like that and that I wanted my money back from them. She told me that she was only authorized to credit back two months and that I would have to write Stonebridge in Plano Texas. This has caused me economic damage as I've been billed for approximately 7 years at $29 something a month for a product that I have not purchased. Along with what they billed me, Capitol One of course tacks on interest.

Every month we mail our payment on time to Capital One. (At least 10 days prior to due date). Every month they state that they have not received the payment until 3 - 5 days after the due date. In turn they have taken an APR of 6.99% and jumped it to 29.99%. We have a rather hefty balance with them (20k) and that interest is destroying us.

I pay my bill online on the 3rd. of each month (It's due on the 6th). I usually pay up to double the about owed but always more than is required. I pay on time and they still add late pays, over the limit charges and high interest. It is totally impossible to pay this bill off or even pay it down because it’s like my payments mean nothing at all. They do not count my payments until the following month.

I received a letter in the mail from Capital One saying they made a mistake; there is an annual membership fee on the account. I called Capital One, I paid the "Past Due" member fee plus interest and the associate combined this account with one of my existing accounts (remember, this is what I wanted from the start...to have my credit line increased. I received a Capital One credit card in 1998. I had several times when I received my statement 2 days before it was due. Making me have to pay over the phone in order to avoid their RIDICULOUS late fees. In 2003 I was having a hard time keeping up w/ payments. I called Capital One to close my account and was told it would be taken care of, but I still needed to pay the balance. I agreed. However, on my next statement I was shocked to have found that I had gone over my limit (due to them charging me the annual fee). There should have been NO charge. The card was canceled and cut up.

Now there was an "over limit" fee and a "late fee". I called and spoke to someone who told me they could NOT take the fees away. They told me I had to pay the balance in full. I explained I could not do that. I asked for a payment plan, and was told they don't "do" payment plans.

The payments I send are usually much more than the minimum- but if the bill is due in two days, even if I have sent say 200. when all that is due is 30, I still get a late fee. I would like to send them a moneygram today but can't get in touch with anything but a robot- the robots can't answer any real questions for me like how I can wire a payment by giving me a routing number etc. It is as if the whole thing is set up so we will continue to be late and pay extra fines. I plan to pay it off and not charge anymore and see what happens.

I feel worried all the time. I am a good bill payer but not with them- I want to be able to talk to people when I have a question for free on a 1-800 number like all the other businesses

In January of 2005, I noticed a charge on my Capital One statement from a credit protection offer that I had declined when I first applied for the credit card. I tried several times to contact the company that provided the service, but I was unsuccessful in canceling. No problem, I thought, I'll just tell C1 to deny the charges.

Unfortunately, their response was that I needed to deal with the company myself and get documents in writing from the credit protection company that they were refusing to cancel the service. Why on earth would a company, that refuses to cancel an account, send documentation stating such? Well, they clearly wouldn't!

C1 told me that they could NOT just deny charges because I requested it. I'd never heard of such an absurd policy, and immediately requested the credit card account be closed. I also paid the entire balance of the card at that time so that I owed C1 absolutely nothing. They told me the account was successfully closed, and I went on my merry way.

Fast forward four months and one (yes, one) statement later, and it turns out that the account was never cancelled. Seems C1 has a policy of REOPENING an account if anyone tries to charge anything within 30 days of account closure. The charges that reopened the account? My annual Capital One fee!

I paid the fee and the additional late fees that had accumulated as a result of not having received a statement until May. At that time, I requested that ALL charges be denied, and that the card be closed immediately without possibility of reopening. I confirmed repeatedly that the account was closed forever.

Fast forward another four months and one statement (notice a pattern?), and suddenly I have a balance of $1200!! The card itself only had a limit of $1000, so a lot of that was alleged overage fees. To date, I still have no reasonable explanation for the balance. I've walked through the charges that were made to the card between May and September (all of which should have been denied because the account was closed), and the total was in the vicinity of $200. The charges came from the original credit protection company and Capital One's late/overage fees. This is where it gets even more confusing (not to mention shady and illegal).

When I started questioning the high balance (I had a zero balance in May) the customer service rep. suddenly changed the story and claimed that I had a balance of $750 when I requested the account closure in May. Naturally I asked where the balance came from, and how the accumulation of charges totaling $200 had been added to $750 to give an end result of $1200. The dumbfounding response was that she did not have records available prior to six months ago, and that because of the high balance, interest over the summer had accumulated to make up the other mysterious $250.

I once again requested that the account be closed and that I be immediately sent documentation on every charge to the account. She refused my request and told me to call the customer service number (which I had called to talk to someone in the first place).

It is now January, and the account is STILL OPEN. I have not made a single payment to it since May (8 months ago), and they keep adding on overage and late fees and destroying my credit. There's no way I can possibly consider paying them while the account is still open because they'll just keep it open and start all over again after pocketing my ever growing due payment. They refuse to close the account, they refuse to deny charges, they don't even seem to want to write off the account and throw it all to debt collection... I have no idea what to do.

About 5 days layer on the Capital One website when I check my account it shows the payment has been returned. I have had more than enough money in my account and there is no reason the money couldn't be drawn. I have tried contacting Capital One to no avail. Try their customer service number and all you get is a canned menu.

Today I had my bank check and they say Capital One never attempted to drawn the money. Intesting enough my APR on my account is now over $28+%. I haven't been using the account and only paying it off. Capital One is now fraudulently adding charges to my account which are criminal. I paid more than the amount due each month. Apparently they want to generate revenue from my account and just the regular interest wasn't enough. My wife works at the post office and she is hearing similar stories from her customers. My father, who is 63 years old, has always taught me that there is great responsibility involved with credit. Leading by example, he was never late to pay a bill in his entire life. He never had any issues with credit, that is... until he tried to consolidate with Capital One. After receiving an offer in the mail for a low-interest consolidation loan, my dad applied via telephone to consolidate 5 separate balances. The customer service rep informed him that he would receive his information by mail. A little over 2 months had passed, and he received nothing. Also, one of the loans he had consolidated had not shown a payment.

Finally, he received a letter in the mail that said his account was past due, he would have to pay several fees, and his name was being sent to the credit bureau. THE CREDIT BUREAU!!! This was my father's worst nightmare considering the lifetime he had put into establishing good credit. He called the number on the letter, and attempted to explain the fact that he had not received any statement. He then asked what address they had on file. The customer service rep said that he did not see an address. My dad then gave his address, and asked for a statement to be sent. After hearing the full account of his situation, I attempted to make calls as well. The customer service people were not identifiable by names... they used identification numbers. You could not call by extensions, and they did not have a fax available to send statements right away. I would have to wait 3-5 days.

I have contacted the company several times and have had no success in getting the issue resolved. I have one payment left that they again have pro-rated up to the next billing cycle (with a finance charge attached) to pay this card off. My understanding from their own paperwork is that if you pay your new balance each month, there are no finance charges attached. God forbid, but it isn't true with Capital One - they are rude, they do not work with you - do not want you to close the account, etc., etc.

I have written a letter and got no results. I have also filed a consumer complaint via the internet with the AZ Attorney General's Office but have not heard from them yet. Unfortunately, I am not a great bookeeper and could not find the reciept so, once again we have paid the same credit card off. I wonder how long it will take until they start calling again. Can we all band together and hire a lawyer? This is causing me a lot of stress and I'm afraid what I'll do if they contact me again.

Obviously when we are trying to pay a card off, it's because we can't afford to keep it. So, this has taken a lot of extra money out of our pocket that we could have used for other things. Not to mention the stress that this has caused. Whoever owns Capitol One are evil people. No good person would do these kind of things to anyone if someone was trying to do the right thing and pay them off. Now, thanks to them, our credit scores are not good. We can't re-finance or, for that matter, try to even purchase anything at a good interest rate. Your screwed if you don't have credit and, screwed if you try to build good credit. So, what's the use. On May 1, 2006 I was looking through my credit report to make sure all was in order. I was planning on refinancing a home and getting into a more fuel efficient car. Unfortunately all was not as it should have been on my credit report. I have been a loyal Capital One card member for over 7 years. During this time I have NEVER ONCE made a late payment. I have never made a late payment on any of my credit cards. This however was not reflected in my credit bureau report.

According to my credit report, with all three bureau, I had made 4 late payments on two different Capital One credit cards. One card reflected 30 & 60 days late in November and December 2005. The other reflected 30 & 60 days late in July and August 2005. I contacted Capital One immediately. The representative on the phone confirmed that this information was in fact incorrect and she would in fact have it removed immediately by sending the correct information to Equifax, Transunion and Experian.

It is now August 3rd and I just got off the phone with a Capital One agent who informed me that one of the accounts has been properly deleted but the other account was being 'researched' and would not be updated for a minimum of 120 days IF they found in my favor. To put it in the most blunt way - Capital One has screwed me. With four RECENT late payments reflected on my credit report my score has fallen over 87 points and I am not 'eligible' to refinance my home or get a decent interest rate on a car all due to THEIR error. The respond by telling me THEY need more TIME to figure out why this happened. All the while my credit suffers.

Let me first say, we are deep deep in credit card debt which is no ones fault but ours! we received a solitation from Capitol One promoting balance transfers and fixed interest rates. On July 5th I called to see what it was all about. I told them I wanted to pay off a $30,000.00 balance I had on a CitiBank Master Card. She told me to give her some personal information and she could do a credit check while we were talking. She read me the long agreement terms and when she was through she said I was approvedfor the #30,000. and did I want to do it. I said yes but first I wanted to know what my monthly payment would be.

She checked and said the monthly payment was $900.00 plus monthly interest. I told her I didn't want to do it and to cancel my request, she said she couldn't do it the loan had already gone through as a wire transfer and couldn't be stopped. I argued with her that it was ridiculous that you could do a credit check and loan for $30,000.00 in less than 5 minutes and not be able to stop it but she said she could not do it and gave me a number to call,1-800-933-5182.

I called this number and talked to Beth, she says they cannot stop an electronic transfer when it is already in process. she said call Saturday the 8th. and they would try to put a stop on the application. I called back on Thursday the 6th and talkedto Rob, he told me the same thing, the transfer could not be stopped and to call back on Saturday, it took that long before his dept would see it. He would put notes on my account that I wanted to cancel the application. I called on Saturday 8th and talked to Yalesea, she said they could not stop the transfer that it went through on 7/5. She said just have Citibank send the money back to them! Told her I wanted to talk to a supervisor, she gave me to Colene. I told Colene what everyone was telling me and that Rob had put notes on my account that I wanted the transfer cancelled. She looked and said yes the notes were on my account. I ask her why then did they go ahead with the transfer, she said they don't read the notes, they just go ahead and do the transfer!!! She was the last person I talked to. I have now received a bill for my first payment for $900.00 which is $250.00 more than what I was paying. I was trying to reduce my monthly payment! Amd would you believe after approving my $30,000.oo request in 5 minutes I now also have a Credit line for cash of $15,000.00.!!!

I went to Capitol One in hopes of reducing my monthly payments. Instead I now am paying $250.00 more a month. I don't understand how they can start a transaction that fast and not be able to stop it. I think I was taken advantage of and I want this complaint on file so that maybe they will not do it to someone else.

This way, you will have to call in your payment by phone and pay Capital One an additional $10.00 for a payment by phone. I am almost paid in full. I can't wait to cancel with this company. They don't seem on the up and up.

I then tried to call the number on my card and it states the program had been canceled. It did not give an alternate # or anything.

I can only assume I am going to be charged late fees as a result of this and at some point over the limit fees as well. I have not received a bill or anything so I don't know where to send my payment! This will eventually damage my credit!

Capitol One had all thse hidden charges that ended up on my bill. After I sent them the letter I noticed that they reported me to the Credit Bureau for being late. Problem is they reported different late dates to three different bureaus. When I complained about that I noticed that they made changes to two of the bureaus and one bureau still has a different late reporting period.

To top it off, they keep sending me credit card offers and I recieve them against my wishes. It is my belief that they report me late so that they can tarnish my credit, therefore it improves their changes that I deal with them for credit. Upon reviewing my credit reports I see where they have been frequently requesting information on my credit. They have me as a adverse credit account and keep sending me unwanted credit applications. I believe the company is intentionally trying to damage my credit so I have to use a high interest company to attain credit.

I mailed my final payment of $297 with a hand written letter and enclosed my cut up credit card. After a month I started checking my account to verify the funds had been received and credited. My money was still in my account!

I called Capital One to ask why my payment had not been applied and was told they had not received my payment nor the credit card and that it wasn't their fault if they lost my payment. I was advised to write a dispute letter and send another final payment, which I did. The account was still not closed and they continued to charge me late and over the limit fees.

My attorney sent them a letter in January 2006. They didn't respond. The only way I got them to respond to me was to, write the CRA agencies as I had been doing for a year. I had to threaten a defamation lawsuit only to have Capital One report the account as a bad debt and as a charge off.

After cancelling the card, we(my father) then a few months later got a bill from them that there owed another $3700 in charges that were accrued after the cancellation. It seems that someone got a hold of the number after the cancellation and ordered a replacement card in my deceased fathers account and Capital One sent the card to another address so the thief could run up all the charges.

We then filed with them a fraud report, and they have not taken the charges off the account. Now they say that there seems to be no fraud. BUT HOW DID A DECEASED MAN MAKE THE CHARGES... We believe that Capital One is also guilty by employee theft of the account, after we called it in as cancelled with no amount owed, and they(Capital One) sold it to someone on the street. I was going to call the company and give them my new address, but I kept on putting it off, since I knew I had paid them off and I had not charged anything else new on the card, I wasn't that worried about receiving my statements. About 2 months after moving, I had almost completly settled in to my new address and thought to call the company with my new information. When I called, I learned that I owed almost $300! This came as a total shock as I knew I had paid them off and made no new charges.

They not only showed no record of recieving my payment, but also has added on tons of late fees, which put me over my $200 balance, so they also added tons of overlimit fees. The fees were growing by the month. I called the company to work something out, but they were unwilling to work with me. A few days later I called my bank to see if the check I had sent Capitol One had cleared - It hadn't. I was really scared that it was lost in the mail or something. I decided that I was going to cancel the original check that I had sent them and send a new check to pay the original $180 and all the fees. I was disappointed that the check had been lost in the mail.

I called Capitol One to tell them that I was going to send a new check. When I called, my balance had been reduced to about $120. What happened? They finally found my check that I had sent several months earlier - the one that I was going to stop payment on because I thought it was lost in the mail! I told them that it was their mistake that the check had not been credited to my account and that I wasn't going to pay the $120 in fees. The phone rep told me that she could put my account on hold while I worked the problem out with management. She said that I wouldn't accrue anymore fees while I was in the process of figuring it out with them. She advised me that the concern would have to be dealt with through the mail.

In February of 2003 I signed up with a Credit Counseling Service - they told me to send them all my bills and they would negotiate a payment plan with each of my creditors for a large fee. I paid the fee and sent my paperwork. At that time my Capital One bill was $947.96 and I had a credit limit of $1000.00. While the credit counseling service was negotitating a payment plan with Capital One it came time for my payment to them - which was never made. Because the payment wasn't made they added $35.00 for a late fee, $17.29 for finance charges which put me at $1000.25 so they tacked on $29.00 for overlimit fee.

Well the next month came and they were still "negotiating" so again Capital One tacked on $35 for late fee, $22.00 for finance charges and $29.00 for overlimit fees. By the third month the finally agreed on a monthly payment of $33.00 of course not in time for them to add another set of late fees, finance charges and overlimit fees. So I thought everything was taken care of but not until July, when I received my Capital One statement did I realize that the negotiated payment is being sent after my due date so Capital One is still adding the $35.00 late fee, finance charges (which were not reduced) and $29.00 overlimit fee.

By now my $947.00 bill had made its way up to $1457.00. I dropped the credit service and ventured out on my own to deal with my credit debt. Everyone I spoke to at my other credit card companies were more than willing to negotiate payment plans and lower interest rates. In August I sent a payment of $100.00 for Capital One and at the same time received a letter from them stating they were willing to help me with a payment plan. The next day I received my statement showing my $100.00 payment before the due date and also showing $29.00 overlimit fees, $25.26 finance charges and $35.00 late fee. I called immediately and spoke to Lisa in collections. Lisa told me because I did not send them $104.00 I received the late fee (of course nowhere on my statement does it say to send $104.00) and they do not do payment plans to "just make a payment before the due date".

So every month I have been sending $50.00 before the 15th. They stopped the late fee but still add finance charges and overlimit fees. Everyday including Sunday, they call me house starting at 8:00am and finish at 8:59pm. They call anywhere from 7 to 18 times a day - we have caller id. I have tried calling them back and they tell me that until I get my balance below the $1000 they will continue to call my house. They were very rude about the whole situation.

I haven't got the money to pay this extortion. I am really ticked off that Capitol One pulls this kind of garbage, and thinks they can get away with it. I have since filed a complaint with the Federal Trade Commission concerning this loan shark outfit.

Capitol One is applying similar tactics as Direct Merchant's Bank. I have faithfully paid my bill on my K-Mart MasterCard each month. Recently I started receiving "Late Fees" even though I had sent my payment 7 or more days prior to the due date. When I contacted Capitol One their reply was, "You need to send your payments sooner. If we do not receive it on the due date you will incur the late fee."

My response was what keeps you from holding my payment until the next day then charging a late fee? Their response (as I figured it would be) "Oh, we would never do that". At any rate one of the late fees placed my account over the limit and I was charged an additional "Over the Limit Fee." My next bill stated the required minimum payment due, which I paid and now I find that there were additional fees attached after the bill was generated, which Capitol one claims they do not have to disclose to the comsumer.

Since I have made the minimum payment I am now receiving up to three calls a day claiming I am late and that I need to do a "Check by Phone" in order to bring my account current even though I have been told that this payment is not do until January 14th, 2004. According to the Fair Debt Collection Practices Act of 1997, 805 USC 1692C(5) Capitol one is in violation of harassment, abuse and annoying the consumer.

Capitol One keeps calling and harassing my mom. She's made arrangements with them and they still keep calling. Also she sent them the card back cut up and said she wanted to cancel the account. They said they couldn't cancel the account till the total bill is paid off. But they keep raking up charges on the bill every month even admitting to my mom that they put $700.00 worth of finance charges on the bill. Mom says how can I get it paid off when they keep adding finance charges on it every month. Is there anything my mom can do to get them to stop calling and adding more to the bill each month? It's crazy.

This was a new gold Mastercard with a $200.00 credit limit, no cash advances, a $49.00 deposit (billed with the first month) and a $39.00 annual membership fee (billed with the second month) and 0% apr for the first 6 months. I charged a total of $183.82 and when I got my bill it was for $381.07. Before I received the first bill they were calling and telling me I was over my limit and I told them, no they were mistaken, let me get the bill and see.

The day I got the bill I called immediately and got no response except for you have to pay. Here is the breakdown of the bill: 36.36 in misc. charges, a total of $147.46 to Lassters Online, a $115.00 cash advance fee relating to the Lasseters Online charge (that's 77.98%), and a $29.00 over the limit fee?

I have been trying to cancel my Visa and Mastercard accounts with Capital One and stop accruing charges since October of 2001. They are continuing to assess charges to J. C. Penney Insurance, membership fees, and late charges made after they acknowledged that the accounts were closed. I stated very clearly in my closure letter that I had stopped authorization for any additional charges on my account and called J. C. Penney and the credit care protection company ensuring any direct charge accounts to them were closed by 11/05/01.

I do not believe that it is coincidental that the companies that Capital One is making the charges for are affiliates of Capital One. Capital One has continued to accrue charges and issue statements to me for unauthorized charges since I received their own letter acknowledging the accounts were closed. They are also attempting to assess late fees because I refused to pay for unauthorized charges.

After long suspecting delays by Capital One of either not sending statements or delaying posting of received payments,I decided to close the account. On 02APR2001 I checked my account balance online, confirmed it with a call to customer service and made an electronic transfer of funds for the complete current balance ($1149.15). Since this took place in the evening, I knew that thae actual transaction would not take place until 03APR2001, the due date on my last statement. I believed this would be the end of it.

We mailed our check of $40.99 on May 17, the payment due date was 5/27. They held my check until june 8. Then charged me 1.66 resulting in three more months they added 77.00 on something the 1.66 that appeared when they held my check.

Then I paid the 77.00 in protest of them holding my check because they threatened to ruin my credit. Then I proceeded to get a bill out of nowhere for $102.00. Originally the $40.99 was paid with 10 days advance they held the check which I have copies of front and back where they held it almost 3 weeks and added $1.66 which they billed $102.00 we are still trying to find out information to get our money back.

I received a Capitol One credit card

with a limit of $200 which was maxed in the first month. My problem
is that they didn't send me an initial statement, the first statement
I received included a late fee of $25 and another fee of $15.
    I called Capitol One to adjust this and got no satisfactory response;
instead they sent another statement with an additional late fee

    and other charges.

Now my statement shows I owe approximately
$600 on a $200 card. This company has taken liberties not specified
in their account agreement statement. First of all they should
have sent an initial statement and afforded me the opportunity
to pay a scheduled amount. Not fixing this situation has put my
credit rating in dire straits. Acquisition of this card admittedly
