My experience is similar to many of the other ones listed here: predatory overdraft or unavailable funds fees. I had overdraft protection in place. I got behind on payments at one point, but was CURRENT on the overdraft line of credit (i.e. Visa) when this occurred. I overdrafted by $40 on Thursday overnight (note that when I checked my balance at an ATM Thursday night at about 8 PM, I had $130 dollars in my account). Friday morning I was $40 in arrears. I made a deposit on the following Monday, by which time I had incurred $245 in overdraft fees - for FORTY DOLLARS in overdrafts!

When I complained that I had overdraft protection in place, I was told that when I got behind on the payments, the overdraft account was disconnected from my checking. I was not informed of this. When I got current again, Wachovia did not reconnect the accounts. When I placed phone calls, the banking side blamed the credit card side of the company, and the credit card side of the company blamed the banking side. A few hours after I made my complaint, I received a very terse phone call from someone who was obviously reading a script, and said all they could do was refund me $25. So I am now closing my account. I feel powerless, and my frustration and reasoning seemed to mean nothing to the customer service rep who called me. Wachovia had a number of things on hold from my check card, and put the largest one through first, which gave me a negative balance, and then put the smaller ones through individually so they could charge the fees for each one. When I viewed my online statement, the first transaction that put me in a negative balance was a $70 overdraft fee from Wachovia! It was dated Thursday night, and the rest of the overdrafts and fees were dated Friday - the next day - including another $175 in overdraft fees. I had heard a lot of bad things about Wachovia, but was willing to try them out since they have branches everywhere and I travel a lot for business. But after this experience, I will not ever do business with them again.

Consequences? I suffered $245 in fees that I can not afford. Not to mention stress, and the time it took me to go down to the branch and straighten it out (unsuccessfully).

Today I received an email from Bank of America saying they put my balance to below zero and are going to take my direct deposit check on Friday. I simply deposited a check I received from the State Treasurer's office, and they made it available. Then 5 days later they said they returned it to the Treasury. I need help a.s.a.p.

So far they are charging me $95 for overdraft charges. I also have direct deposit going to this account which they say they will take. I also have direct payments coming out of this account. This has caused me to be sick all weekend with this unending mess up. Please help.

Deposited a check in the amount of $400 for a car I sold on Ebay. The buyer is located two hours away. After the money had shown as cleared online, I spent the money. Two days later, my account shows as over $1200 over-withdrawn.

I called Wachovia and was told that somehow after the branch marked the check as received, they lost the physical check. So they had to take the $400 back out of my account, along with an additional $400 to cover the check. In doing that, they caused several other transactions to bounce.

I was told that I would need to contact the person I recieved the check from, have them cancel the previous check and issue a new one to me.

When I called this person and explained this to him. He told me that his bank would charge him $35 to cancel the previous check which he would have to charge me and the bank would only repay me if he gave them a letterhead stating that they had charged him.

So, now I must take off work on a weekday, drive down to him 2 hours away, go to the bank with him, get the letterhead, go to my branch, get re embersed for the cancel check fee. Fight over what charges I can get re emberssed from due to everything bouncing and close my account.

So far it looks like roughly $300 in overdrafts which I may be able to get back in time. Plus the lost wages from having to take off during banks business hours. Plus $40 in gas for driving to meet this guy. I also received bad feedback on ebay due to not being able to pay for an item I had won. My powerbill is late due to not being able to access funds. They need to realize that not all of us have extra cash in the bank to cover their mistakes. Estimated loss, over $360 for this $400 check.

I recently was charged $175.00 in unavailable funds fees from Wachovia. This was the result of a check posting to my account that put the account in deficit. However, Wachovia decided to post this check in favor to several smaller transactions that had been in hold status while the account had ample funds. Once they account was overdrawn, they put through these smaller transactions, each of which incurred a $35.00 fee for unavailable funds. One of these transactions was actually an ATM withdrawal. How could the funds be unavailable if I already had them in hand? I would like a substantial amount of the fees refunded to me. I really just think someone should look into this very suspect business practice. It is criminal.

I am a single person living on a moderate budget. This type of tax has quite an impact on my month.

There is no way I signed up for Credit Protection Plus. After digging further, Bank of America uses a third party company called CIC which administers the plan. I was charged two big fees before realizing they fraudulantly enrolled me in the plan and the last charge pushed me over my credit limit which alerted the credit bureaus that I am over the limit.

I'm currently fighting with Bank of America to get back the fees charged and get them to straighten out the over the limit notification to the credit bureaus.

I have a checking account with Wachovia Bank, and use a debit card to charge purchases. Last year in June, my account was charged $88 overdraft protection for 4 purchases (biggest being $9). I called the back at the time, and requested that overdraft not be allowed on my account. I was told that it would ensure that my account does not go in overdraft.

On 11/12 Feb, my account was again charged $175 overdraft fee. The balance on the account on the 12th Feb (without making any deposits) was $178.78 overdrawn, out of which $175 was overdraft fee for 5 transactions. I complained to the bank that firstly, I opted out of the overdraft - so the transactions should have been denied. And secondly, no matter how they calculate the overdraft fee, charging $175 for a $3.78 overdraft makes no sense.

The bank said there are no opt out instructions on the account, and offered to refund $35 of the overdraft fee.

Banks have ridiculous overdraft charges, it is high time legislation was introduced to protect consumers.

I have banked with Wachovia for around 12 years. I really haven't had any trouble for the most part that was not self-induced, until about 7 months ago. Around August of this past year I really started getting hit with some crazy ODF numbers. I always just blamed myself....that it was something I was doing. I started really hammering down, checking my account daily, trying to keep a current balance, etc..

However, I could not make any sense of what was going on and continued to get ODF. After about 5 months of this and trying to figure out how this continued to happen, I did figure out that....yes, they are posting transactions HOW and WHEN they feel like it and which honestly appears HOW and WHEN benefits them the most in getting fees out of you.

I have been tracking this for months. I am fairly intelligent person and I still have been unable to concretely figure out the rhyme and reason as to how they are processing transactions. What is even more frustrating is when you call customer service or walk into the branch for some explanations..... they have absolutely no idea either. They cannot give you any explanation.

For example, I can be on the phone with customer service looking at the screen on the computer and the customer service representative is looking at something completely different, and further, cannot explain what you are seeing.

I have printed off several days in a row off the online screens. It absolutely blew me away at how every day the balances change, transactions shift, etc., sometimes 3 or 4 days back. Again, call and ask for a explanation.....answer is I don't know. My screen shows.....

Today I went on-line to check my account, once again I have $140.00 in ODF. After further investigation and a call to the bank, I still do not know what or how that is....first off there were only 3 transactions that went through since yesterday, the only 3 I had out..... and there was money in there to cover all three. When I look on my screen it shows the first 2 ODF are what overdrafted me, not the transactions, and then when the third transaction went through they charged me 2 more ODF. This makes no sense and once again no one at Wachovia can explain it to me either.....BIG SURPRISE!

The whole reason I came to this website was I hoping that there was a lawsuit somewhere, because Wachovia has got to be doing something illegal somewhere. If not necessarily illegal, then they are stacking all the loop holes they can in thier favor for them to benefit and most likely end up with some of your money in thier pocket free.

I have been with Wachovia bank now for 10 months. It has been a horrible, costly experience for me and my family. I found out today that my account is overdrawn by $912.97 and still have 2 transactions that they have on hold. We track our money real closely and our account balance was at $882 before the bank closed on Friday. They tell us on Tuesday that our available funds were only $712.92. With no transactions occurring between this time. Several times now they have held transactions to try and get ODFs out of me. I have called different merchants and have them tell me they have already posted this transaction. Wachovia will tell you that that is when they sent it not when it posts with the bank. Yet, when it suits them the transactions post almost immediately. Sometimes they hold them for over two weeks but your balance wont reflect the hold. Someone needs to stop them from doing this because people like me live check to check and now we don't have a check to live on this week.

It cost me $882 ODF's not to mention I live check to check. So now I will have to go a week without electricity. 2 days of food left and still other bills I'm not going to be able to pay now. Someone needs to put a stop to this.

I recently opened an account with Wachovia. I've been dealing with a Credit Union for many years but decided it would probably be best to have a few bank accounts. I made several check card purchases over the weekend. I also wrote a check for $2000. I check my account on a daily basis and when I checked it this morning I had an overdraft fee of a whopping $198! I called Wachovia to find out how is it possible to have an overdraft fee of $198. I was told that my transactions are processed from the largest amount to the smallest (even though a lot of these transactions have still not posted to my account INCLUDING THE CHECK FOR $2000). Meaning they processed the $2000 check first then all the smaller transactions next even though they are still on hold. It does not matter what order they come in. I received a $22 fee for each of the 9 transactions that was processed after the check. Many of these transactions were under $10. In all the years that I've had a bank account, I have never heard of something so ridiculous!! In addition I made a deposit yesterday that would have covered all of my transactions and they did not post it until this morning. I am closing my account with Wachovia IMMEDIATELY!

I was busy moving to a new area, and I wasn't aware the entire time that the Fee for the plan I never wanted was causing me to become overdrawn. Their own overdraft fees were further causing me to become overdrawn even more so; they kept multiplying until it got to $711+.

A week later I called BofA customer service 800 number to ask about it, only to find out that the check was never cashed because it was issued under my name as well as my boyfriend's name. I asked the banker to send me the original check to my current address.

It has been more than ONE MONTH after I initially tried to deposit the check. Bank of America loses my check. I ask BofA to send me a copy of the check, and I receive something totally worthless. I was then misled to believe that I could deposit an invalid document, then I am told to wait one more week after a month of waiting for the check. I WAS COMPLETELY FRUSTRATED WITH THEIR RESPONSES AND CUSTOMER SERVICE!

I am now behind on my credit card payments, utility bills, student loan bill and medical insurance bill. My bills are pilling up, and my credit card may file a claim against my credit report. If I don't get this check cashed soon, my situation will worsen, and my credit will be severely affected. I need serious help to sue BofA of moral and financial damages that this has caused me.

I am getting really tired of Wachovia telling me when I often ask if the deposit goes in first before any deductions are taken out of the account and I get the same answer of Yes however that is not the case.

It seems that Wachovia's practice is to make all deductions and then deposits, this way they can get all of their NSF fees and make money off of the patrons that bank with them.

I recently liquidated some assets to pay off my house and received a very large check. I went to Wachovia and asked them if their would be a hold on this check and they said yes. Naturally I thought it was because of the size of the ckeck, but, found out this was not the case at all. I asked how many days that the hold would be for and the teller told 7 days. Well this caused me to miss my payoff date therefore, it has now cost me more money to pay off my house and get another payoff draft summary.

After I received my deposit slip I noticed outside the bank that the hold was not for 7 days but actually for 10 DAYS!!!! I went back in and confronted the teller and she said that they did not count the day of the deposit even though it was made at 9:00 AM and they did not count the holiday or weekends.

The reason for all of this was given on the deposit slip as We are delaying the availability of the funds you deposited as indicated below. We are taking this action because: You have overdrawn your account repeatedly in the last six months. This is the reason they have given me to hold my payoff check for my home. I understand it is every businesses goal to make money but, making money using unfair banking practices is going to far.

Last year my son, who also banked with Wachovia, who is in the military and is stationed in Washington State closed his account and suffered at Wachovia's unfair banking practices. Wachovia does not have a branch where he is, so he gets charged an outrageous amount of money ever time he used his debit/visa card. The amount he was charged was $25.77 every time he used it. When he would inquire how much he had in his account it always showed a positive balance. He would use his card and then get charged multiple NSF fees. His fees every month since he has been there has been totaling almost the same as his paycheck.

One time he was not able to pay his NSF fees all the way down, so Wachovia being the great rip off's that they are went after mine and my husbands account since I was a second signature on my sons account and they removed with prior notice the amount that my son had over drawn to a whopping some of $140. I could not figure out where my money went to as I had NO prior notice. This caused my electric bill, mortgage and water bill to bounce, which Wachovia was ever so happy to charge me $35 for each NSF.

I later received a notice 1 week later that they were pulling the money out of mine and my husbands account to pay my son's NSF's. I am going to be closing my account with Wachovia. I have been lied to and cheated out of my money. I will not EVER recommend them to anyone. My account has never been accurate. My legend has never matched theirs, there is always a difference. No one at Wachovia is helpful, and it is always my fault. I'm over it!!!!! And don't get me started with Country Wide!!!!!

In 1999 my husband and I were looking for a way to invest a lottery winning. Wachovia (First Union at the time) was more than happy to help us plan out our lives. We received so much support in investment strategies and oppurtunities for our future. We were advised to invest all of the money with Wachovia and take loans out against the money. Sounds dumb now, however, Wachovia showed us how our investments would earn more than the interest on our loans. Even if the markets were to change (which they did) we were building a long term relationship with the bank and that would work in our favor.

Our brokers came and went and our porfolio dropped about $300,000 over a 3 year period. Of course, when we complained, we were told not to panic because the long term outcome would not be affected. Our last porfolio manager decided that we should not be in the stock market any more, he sold all of our stocks in one day and put our balance into a money market account earning less than one percent. We were perfect customers. They held our investments ransom. We were told that if we renewed our loans for another year, Wachovia would release our porfolio back into a higher yilding account. We didn't have a choice.

I was admitted to the Veterans Administration Medical Center in Asheville North Carolina on July 9, 2007. I was discharged on July 19, 2007 after receiving 3 units of blood, 1000 milligrams of iron and platelets. I was given a diagnosis by the cancer doctor at the VA hospital August 13, 2007. I was told that I had had acute myeloid leukemia for at least a year and had approximately one year to live. I was hospitalized again on October 27, 2007 at Park Ridge Hospital in Fletcher North Carolina. There, I received both blood and iron and was discharged November 5, 2007. I have credit cards with Bank of America, Household Bank, Providian (Washington Mutual) and Chase Bank. Although I had Credit Card Protection with all of them, ONLY CHASE BANK immediately deferred my payments with zero interest from the time I let them know I had cancer. I called Chase Bank; they gave me time to send proof of my condition, it was that simple!

Bank of America has referred my account to a collection agency! I have had a 60% military related disability for several years; however, since the diagnosis of acute myeloid leukemia, I am now 100% disabled. My medical and personal expenses have risen significantly, and I haven't been able to be as independent as I was previous to my first hospitalization in July of last year. I've been treated by a doctor who wrote a letter for me stating I was 100% disabled, which I sent to all the credit card companies/Credit Protection Agencies along with a pathology report. Since becoming 100% disabled as of July 9, 2007, I haven't used any of my credit cards, while continuing to make all my payments (with the exception of Chase Bank) through November 2007. During this time I was repeatedly faxing and mailing reports, and calling to inform the credit card companies and their Credit Card Protection Agencies of my condition.

Every day I'm STILL RECEIVING calls from representatives of the credit card companies. Sick people do not need people calling them from 8:00 am till after 8:00 pm, and even on weekends. My doctor says this continued pressure by the credit card companies is to stressful for me and is not good for my condition. Two years ago I sold my home. The people who bought my home defaulted on the first mortgage, and I lost over fifty thousand dollars because I had agreed to hold a second mortgage for them. Losing all that money did not create as much stress for me as the credit card companies/Credit Protection Agencies are generating for me at this time in my life! Thank you.

Wachovia put through the larger of the 2 transactions first so the could access two $35 NSF fees. I immediately deposited $7.02 and called Wachovia asking them to waive the fees. When I spoke to the people at 1800wachovia, they will not give out a phone # to there executive offices, but the will give an address.

It is more principal than anything else. How unethical is it to purposely maximize overdraft income. The day of my contact with Mr Bell, it was 2 degrees outside. I am convinced that Bank of America is profiting from charging bogus overdraft fees. When making cash deposits prior to the cut-off time, I've been told it would post the same day only to find out they post the following day, which has resulted in overdraft charges. Also I paid $28 to do a stop payment on a transaction only to find out after they sent the transaction through and that it takes 3 days to stop the payment. There was nothing in writing stating this and the customer service rep who helped me never mentioned it when I paid the $28, which was deducted from my account immediately. Then when I called customer service, they told me there was nothing they could do; but, valued me as a customer.

I have lost over $200 to the bank of america in overdraft fees alone because of misleading information from the bank. However, they convienently forgot to switch the automatic savings plan off since it was no longer going into a interest bearing savings. This has caused many headaches for me.

First, I had enough money to cover a payment for a purchase I made with this feature they forgot to take off with the switch they charged my account a NSF fee and trans fee of $10. I went back through my records and BOA did this to me on multiple occasions. They said it was my fault because I didn't notify them and would not refund any of the money. The estimated total last year had to be over $100 in the $10 fees and almost another $100 in NSF fees. When I complained they said it was my fault. I asked if they converted the account why didn't they take that feature away since it was not a savings? They replied it is my responsibility to tell them. I find that somewhat amusing seeing they made the changes to the account and never told me I could have the keep the change savings on a checking account. I know you might think why did I not notice this sooner and it is simple, $10 leaving my account at a time I just didn't notice, but a deeper look into my account upon the year review I find out. I was also told if I replenish my account the same day prior to 2pm I would not be hit with NSF fees. Each time I have done this they have denied my request. I currently have 1 investment account with BOA, 3 Checking. Out of all the banks I have banked with Bank Of America has the best service to your face but lacks delivery

Everything that I have read on this website about Wachovia is so true as I had it happen to me repeatedly over the past several months.

I opened my account with Wachovia earlier this year because of its convenient location to my home (1 block away, if that)

Anyway, I already had $450.00 just prior to having my Social Security Disability Check of $813.00, as well as my kids SS checks of $137.00 each for a total of $1087 combined equaling $1,537.00 and then right after that my husband's unemployment check came in for $444.00 for a grand total of $1,981.00. I went in to Wachovia for a cashier's check in the amount of $850.00 for my monthly rental which, when subtracted from my account, equalled $1,131.00. I went grocery shopping at Walmart and used my debit card for $200.00 for groceries which should have left a $931.00 balance!!

Well the next day, I looked at my account on Wachovia.com and found that they did not give me credit for the 3 direct deposits that I had from SS. I called the representative at Wachovia and was told that depending on when the direct deposits came in, they have the option of holding them for a certain time period and that I shouldn't have spent the money until I was sure they were credited. I couldn't believe it!!

I thought that when a SS check is direct deposited, it was as good as cash. They nd I charged me $35 for each transaction that had come in somehow totaling $656.00. Come to find out that they canceled the cashier's check for $850.00. I still haven't got a valid answer for that. Anyway, I'm now out quite a bit of money and have cancelled my account with Wachovia. I will never go back to that bank.

They have refused to return approximately $30,000.00 that was fraudulently taken from my handicapped, bedbound, and now deceased mothers accounts with them. I have sent them proof of this, the names of some of the people who did it, which I had to investigate on my own while grieving the death of my mother since Wachovia was doing nothing about it., copies of the checks along with some of the peoples arrest records, which include FRAUD.

I even have an eyewitness, a store owner who identified one of the people who fraudulently used my mothers debit card in her store several times. The person I was told who was in charge of the fraud department (Maralyn K) first refused to even speak with me when I initially called. I had to get a news group after them before she would even get on the phone with me.

On about my thirtieth call to them one of Wachovia employees told me that this woman (Maralyn K) even accused me of being in with the people who stole this money from my mother.

When I finally spoke to this Maralyn K, I asked her what Wachovia was going to do about this and the main question she asked me was Well, that depends on how much money we are talking about here.? My first thought was why does that matter, there are numerous fraudulent transactions on my mothers accounts and they need to pay the money back. The amount should have nothing to do with them doing the right thing. Well, it did.

They decided that keeping the money that was taken from my mothers accounts was more important then having a bad reputation. They sent me in circles for months then came back and told me they would not do anything about it. They would not return the money and they have not prosecuted the people who did this. Let us show them the power of the consumer and boycott Wachovia Bank until they pay this money back!

My plans to buy a home for my family are gone. Money that was going to go toward my 2 year old daughter's college is also gone. My anxiety level has been sky high and I can't sleep much wondering why they are treating me this way and what I can do about it.

They took it back after I had spent most of the money and was still in the positive. When they took it back, they put me in the negative and gave me overdraft fees for about twenty or thirty check card purchases. The lady I spoke to at the 800 number refunded about one or two hundred dollars, but that's it.

I was left about $1000 in the hole, and am now in their recovery and chexsystems, so that I can't open an account at any bank.

Luckily for me, I save these slips just in case. Now, they have made an investigation even though they can clearly see the deposit isn't showing and I have proof of this deposit. I am waiting for a check to go in for my rent and I am totally worried because they are taking 24-42 hours for the investigation. How can this have happened?

Neither Credit Protection or Bank of America will refund the money that was stolen from my account without my authorization.

Not only have we had to literally fight to close our accounts with Bank of America, but now we are receiving mail that in fact slanders our name and credit rating. The letter gives no dates or proof. This sort of treatment has been going on for some time, and we are feeling not only slandered but feel they are in fact harassing us and our good name. We have the closing receipts showing the dates all accounts were closed. The letter received from Keith Palmer is dated for Jan. 24, 2008--clearly after the date that all accounts were in fact closed by us.

This constant treatment is causing great stress and despair. We are feeling threatened by this constant harrassment and the possibility that they could damage out credit. We don't understand how can this sort of treatment go on in this country?

Ihave noticed that Bank of America charged me $350 in overdraft fees because they charged out first from the big amount and them the small amounts, to make you fall in overdraft fees--even though you have spent small amount in the morning and the big amount after 4 pm. For Bank of America, it is when you withdraw money from your account after hours (4 pm), they won't count it for next day transaction; but if is a deposit after hours, they will credit it on the next day transaction. That is how my account falls on overdraft.

These frequent overdrafts are causing economic problems. I thought Bank of America will base it on the interest of their loans--no, from billions of dollars they charge their loyal customers.

My complaint is about the time taken to reach a customer via telephone and their ability to resolve the problem. On the first attempt I spent nearly 50 minutes and gave up. Because they transfer from one dept to another and so on. And at one point, the system disconnected. BofA ask so many questions in the name of verifying my identity and finally that guy doesn't resolve, again goes to another dept. I did a simple math for the interest amount that I will lose on a .1% which is about $8 for 4 month. So I decided to give up instead of wasting my time. On a different note, I want to notify them about the maturity date and it is so far taken 20 minutes to reach them, so has to disconnect. Poor Service. I will not choose BofA in the future and eventually I will close all my business with them. Another funny thing they provide in the cd receipt of associate phone number as 800-432 1100 which takes to a bad entertainment line.

After contacting Wachovia I was told that this happened because other purchases that were on hold? had amounted to a larger sum than the available funds. Three subsequent overdrafts ensued the following day. Realistically, two more should have occurred based on the sequence of purchases. Wachovia is a very sneaky bank in my opinion. I believe that they have a policy that they process the highest or most amount of money that you spent on a check card. I fell victim to this very sly way for gaining another dollar. I had deposited $31.22 in my checking account. I've come to this website before and I knew that the Online Banking that Wachovia has is somewhat delayed in the time that the information is processed. So after depositing the amount the $31.22, I waited 3 days for the money to be processed. Soon afterwards, I made two purchases online, which brought my account down to about $5.62. After going online, I saw that it had been correctly deducted from the account. So, I make another purchase, which I end up overdrafting on only 24 cents. To balance that, I deposited $5 into my checking only 2 hours apart from when I overdrafted. So the next morning, I see that I have overdrafted $22 two days ago! Apparently, when I deposited the $31.22, I seperately withdrew $18 dollars and had $12. Then I overdrafted somehow, which put me in by $22 and the next day, I put $5 into the account first. THEN spent more money on the next two purchases which gave me even more overdraft. The total owed was $85 by the end of the day. So my question is, how could I overdraft, when I apparently spent $18 from $31.22? And yet, the representative I spoke to said that I only had $12 and that I spent over that.

I only had to make a huge loan for the $87. But being a freshman college student, I don't have enough time, nor energy to come up with $87 in a day. I am starting a new job and since no money is coming in, who knows how much more I would have had to pay. I will definetly NOT recommend Wachovia bank to any of my friends or family. I will also tell a close friend of mine to get out of a Wachovia account and move on to someone better. I won't look at banking the same again and being as young as I am, this will definitely affect my decisions in life.

It was set to be delivered on a specific date. On that day the website said it was sent, and the funds were withdrawn from my checking account--except they weren't. I noticed the balance had not adjusted. I called the 800# to ask about it, and they said they do not withdraw funds for at least 24 hours. But that's not what bill-pay said; bill-pay said the withdrawal was made the day the payment was delivered, nothing about a delay. If I had not caught that I would have spent money that was already spent.

There can be no reasonable explanation for this other than BOA hopes to trip you up and nail you with overdraft fees. It's the same reason online banking is as ridiculously complex as it is--with pending charges and delayed deposits; nothing is in real time. The balances you see are never the actual balances. It's like everything they do is oriented toward pumping more outrageous penalty fees out of you. What ever happened to honorable business practices? BOA is more like a slipshod bazaar.

It did not show up as pending on my online banking; it just cleared overnight. Due to BOA's policy of processing the largest debits first, down to the smallest, this transaction, which should have caused, at most, one overdraft fee ended up causing five, totaling $175. BOA, after I pitched a fit, credited back $86 of the $175, and then I was later able to get another $35 taken off. This is the second time in a week that I have checked the account before the cutoff time each night for transfers, thought the account was in good shape, only to wake up the next morning to a handful of overdraft charges. Some of these charges come from ATM withdrawals, where they could have simply refused the withdrawal if there were insufficient funds. I have researched banking law, and everything they did was legal. My complaint is that it should not be legal. I don't feel good about entrusting my money to an entity that is using every legal means they can devise to get it away from me. I'm ready to put it under the mattress.

I lost $229 in overdraft fees that were beyond my control because the bank failed to disclose information about how debits are processed and loaned me money to cover overdrafts without my consent, at, I might add, a rate that is far beyond usurious. I would like to see a class action suit against any bank that uses high to low debit processing as not acting in good faith and protecting the assets of their customers.

The total amount of the debits were less than thirty dollars. The charges were more than three times the amount that I had charged. I made these charges because my bank balance was positive and more than the amount that I had charged. One lady told me that as long as I deposit money, there wouldn't be any charges while another representative told me that the bank will go back and clear debits or charges on the day that the card was used, not the day that the transactions cleared. Regardless, I'm out $105. On top of it all, I went to use my husband's ATM card which was not a Bank of America card. I waited for the card to be returned and it was not. My mortgage payment was scheduled to be electronically withdrawn the next day, and I wanted my deposit to go in as cash. I was told that they could cash my checks for me and give me the cash, but they would not deposit the cash in another account for me. I spoke to the bank manager, and he gave me the 1-800 number to make a complaint to. When I left the bank, I called and they told me that this is now a rule. It makes no sense to me to be able to receive cash for the checks, but not be able to deposit the cash. They explained to me that this rule will help reduce fraud. I think it's an unfair practice for the consumer.

Only inconvenience, and loss of time.

I worked for Progress Bank in Plymouth Meeting, PA for ten years plus 5 months. Approximately 7 months before leaving the bank, I transferred my 401k to Vanguard (completely forgetting I now had almost a year’s worth of 401k funds that I had not remembered to transfer). Consequently, Progress Bank was sold to Fleet Bank. I allowed my checking and savings account to be moved to Fleet Bank. About 3 years after buying Progress Bank, Fleet was bought out by Bank of America. This past September 2007, I received a letter from Social Security telling me that $2,195.00 in IRA/401k funds were showing up under my name. My first step was to see my branch manager at Bank of America in Trooper, PA.

After reading the letter from Social Security, he informed me he would look into getting the funds transferred to my checking account. A month and a half later, the funds were still not in my account. So I went back to the branch and spoke to the new manager. He went into his computer and told me he did not see the $2,195.00 seen by the first guy. He then informed me that when Bank of America purchases Fleet, they did not buy their IRA/401k accounts. He told me I had to contact Fleet Bank (which I have been unable to do). After speaking to countless associates at Bank of America and getting no satisfaction, I wrote to Social Security for advice as to how I could settle this matter. I was told he found it very strange that Bank of America would not include IRA/401k assets when purchasing Fleet and that he would continue to pursue Bank of America.

All I asked for was for proof that Fleet Bank either had or did not have these funds. Then, I could at least have some documentation that showed Bank of America and to get the money they were holding somewhere. I am well aware that my puny $2,195.00 is nothing in the grand scheme of things; however little as it may be, I believe the federal government regulations state that all lending and banking institutions must send a statement to all its depositors. I cannot find this needle in the haystack. Could you please advise? Any suggestions would be greatly accepted. Thank you for your time.

I went to an ATM to pull out money for lunch, when I got my balance receipt it said my balance was -$9. I called the bank to find out how I could have a negative balance and they said they give me the money from the atm as a courtesy, but charge me the overdraft fee anyway. Due to the money they let me take out and my poor banking skills I overdrafted three more items under their pay the highest debt first rule leaving me with a balance of -$198.80. I asked them to return some of the $175 in overdraft fee's and they told me no because of previous accout refunds for problems with their deposit processing scam - the one where you have the money available, but it can't be used to pay things because it hasn't posted.

So I start to pay some of the money back, and low and behold, they allow another charge to my account for $14 and another $35 overdraft fee. I worked the account down to -$73.94 after being harassed for two weeks to pay off the account, and now it's back up to -$136.94. I don't have all this money to throw around. To make matters worse, they reported me to check systems for an old account I had with them, that I have paid off over a year ago; because of the report to that company - which I have tried to contact but have been unable to do so - I can't get a checking account with any other banks, and Wachovia won't ask check systems to remove the note on my name. I'm between a rock and a hard place.

My husband and I are on disability that we receive by wire transfers from the state and federal into our Wachovia account. One is on the 3rd and the other on the 1st. Before we became Wachovia we were called World Savings and Loan. When the transfers of our fixed income were made they put holds on them, so that 10 transactions came through and they bounced them to the tune on $225. Right now I can't get a hold of them because it's the middle of the night. I was worried that this might happen so I checked my account earlier today and they had my wire transfer made and no other checks had come in. I couldn't sleep so I came in to check it again and now see that they have done this. So My husband and I are going in tomorrow and closing our account with them.

We have been with World Savings for 30 years and with Wachovia for 6 months. We have many changes to make with life insurance, loan payments. and the such that come directly out of our account, but this is no problem compared with what they are doing to us. I have our bills to the penny with being on a fixed income. My husband has had 13 spine surgerys and one neck surgery. I can't work taking care of him and my disability's. I wish I had thought to copy the account when it said that the deposit was there but not the 10 transactions, but of course I didn't think they would do that. They have these little asterist at the end of the deposits that say processing with a cross looking like thing. Then you go down to the bottom of the page and it says pending transaction in balance column has not yet posted to your account. Why, when it was wired? They didn't do it that way when it was World Savings. As soon as the deposit was made the money was available. Now its not. All I can do is close my account. I'm going to Butte Community bank. My daughter works there and she said she would take care of our account and not let anything like this ever happen. I hope no one has to go through what we have. If you have a Wachovia account close it.

We watch our bank account online everyday to make sure all is well. If you look at your account first thing in the morning you will see what was debited from your account that morning, and if it is negative you can go to the bank and deposit CASH so it's credited that day--and then there are NO NSF fees. BUT I checked it on Dec. 23-Dec. 25, 2007, and my account was positive and all was well. THEN the morning of the 26th I checked it, and it was $22.00 negative, and they back-dated it to the 24th. I went to the bank as always and deposited the money to make positive, then that night they hit us for $105.00 NSF fees.

I called CUSTOMER SERVICE, and they would not remove the fees. It did not matter to them that they back-dated the debits making it where I was not able to fix it before their $35.00 fees hit me. It did not matter that we have direct deposits from our work to them, and that we have done business as long as we have, or that we bring them business when we can send it their way. These where not checks we wrote, for we never write checks. These were debits from stores that should have been taken from our account the moment we bought something--not days later. Bank of America is not a customer friendly company, and we along with several others are closing all our accounts and moving to a different bank, ASAP!

THEY STOLE $105.00 from us at CHRISTMAS!

Over the last two years trying to get a live person on the phone without having to go through their automated voice system is an effort; you better have at least an hour of your time to do so. I went to a local branch in order to clear up some issues with my equity line of credit, and they gave me an 800# to call. They could not help me in the same bank center that set up my account. I was transfered 5 times before someone could help me, and then I was instructed she would have to transfer me again in order to draw funds out of an account to pay my equity line of credit.

My advice to anyone who is thinking about switching to Bank of America: think again. I will take my local bank with two locations over the monster with thousands. You are just a number with Bank of America, and they don't care about customer service. I went on line a couple of days later to check my balance, and I discovered my account was a negative the amount of the deposit I made and all checks and ATM purchases. I was charged a $35.00 over-draft funds fee. From first glance it looked as if the money was credited and my withdrawals were subtracted, but it wasn't; and after several attempts to get BOA to release my money, they refused and continued to extend the day my funds would be available which would be on December 15, 2007. Then they said December 18, then December 19.

So far I'm over $350.00 in over-draft fees, and every check I've written has been returned. I was not given an option when I made the deposit on whether or not I wanted to continue with the deposit; and I was not notified about the hold until December 15, 2007. I would have never completed the deposit if I had known BOA was going to hold my money for 2 weeks. I can't afford to have my money held that long and be without no money at all--for whatever length of time they feel it necessary to withhold EVERY cent I have. Since I opened my account with BOA this is the first time this has happen. BOA is not only holding my money order deposit, but they have taken my direct-deposit and applied it to the over-draft fees they have charged me.

I'm now over $350.00 of over-draft fees BOA has charged me. My lights were turned off on December 14, 2007; I can't buy food. The checks that were paid out for bills were returned, and I can't get to my money to make those checks right. I ordered medication which I take daily but I can't get because I don't have any money. I can't make my doctor's appointment. I have not been able to sleep or even function because of this. I feel BOA is the Grinch that has stolen Christmas from my family. Customer service is more interested in trying to figure out how to keep from giving me any of my money back rather than help their customer out of this situation. I purchased a new 2007 Hyundai Santa Fe in Aug. '07,and Wachovia Dealer Services is the auto loan provider. Before accepting the vehicle I obtained approximately a 1.8 million dollar insurance policy for full coverage on the new vehicle. The full coverage was verified through Farmer's Insurance at the Dealership and forwarded to Wachovia. From August 2007 through December 5, 2007, the insurance agent, the policy holder/provider and I have faxed, phoned, and certified mailed, full disclosure of full insurance coverage. Wachovia arbitrarily assigned their designated insurance coverage, attached it to my auto loan and proceeded to add that insurance, as well as subsequent late fees and collection charges, to my auto loan acct. To date the 2 agents and myself have contacted the company on average of twice weekly.

Wachovia has reported 2 late car payments to my credit report adversely effecting my credit. Wachovia service rep Angel phones my employer leaving messages regarding my irresponsibility in paying my auto loan and urgent call to return for wage garnishment for unpaid auto loan that can result in repossession of my vehicle. He has contacted my main employment office and my direct supervisor's voice mail despite being told (I recorded three of the calls w/ digital recorder) to have no contact with me, my employer, my work contacts. He replied there is nothing you can do--you will pay us the amount owed and we will continue to contact you and your employer. His supervisor Nick, at same toll free number has been fully apprised of the violation of my rights w/ Angel and the situation with Wachovia's error.

Nick assured me and insurance provider that he would take care of the acct. error, and that sometimes not having Wachovia as the direct lien holder can bog the system. He has not returned our calls, nor made any effort to correct Wachovia's error according the the 5 calls weekly I receive from Angel and other csr reps. Currently Wachovia is denying yet another monthly auto payment; unless of course, I pay the late fees and the late fees w/ the insurance binder amounts attached.

The negative impact of Wachovia's actions continues to impact my life. In my employment, integrity is the foundation of employment and promotion opportunities. I have had to take 2 days off work (with pay) to clear up the nonsense of my personal loan life that Angel's phone calls enhanced. My monthly $479 auto payment is currently listed at $955.69 for December--and the ability to pay the 12/9 auto payment only denied. We have gone beyond any reasonable consistent attempts to correct their error. My auto insurance is at such an over-compensatory level (million dollars plus) that federal auto loan insurance laws and state laws supercede any company's existing policy. As of Monday, I am retaining legal counsel. I intend to seek criminal and civil compensatory damages and would like Wachovia held publicly accountable. Farmer's Insurance agent, Farmer's office, my provider's professional office and agent and myself have well documented contacts and all attempts to show full insurance coverage. I have begun digitally recording all messages and contacts, threats, etc. w/ Wachovia and state that I am recording the calls with full intent to use any and all information against them in federal and state courts of law. I have sent a certified copy of intent to seek damages and to fully record all contacts with all employee's and any representatives of their company.

I had $50.00 in my savings for supposed overdraft protection which could have covered these purchases had it been transferred over BEFORE they assessed $175.00 in NSF fees. I called and spoke to 2 different people and they explained to me how 1) online is not real time and 2) that's not how overdraft protection works. I'm so upset that this is their explanation - it doesn't make sense that the overdraft protection really doesn't protect from overdrafts at all. I don't believe that the overdraft protection is protection at all. If the $50 doesn't make a difference (as they claimed), then why do it at all? And then charge me $10 to process the transfer on top of it. The rep refunded 15% of the charges ($26) as a courtesy, but I still feel like I've been lied to about overdraft protection when it was pitched to me.

Damages are that, as of now, before my deposit is credited and after the refund is credited, I have a balance of -$171.63.

Please help me to find out how I can claim that check upon retirement! A contact address or who assumed their pension program would help greatly. Thank You. I'm afraid of losing a pension that is rightfully mine.

I am furious with my recent experiences with Wachovia. I check my account balances daily if not more than once a day. First of all, you cannot count on the information. They change it to force overdraft fees. For example, the ATM and withdrew $20 in one transaction. I then immediately made a deposit into this same account. Later then I looked at the account, there were FIVE transactions in between the deposit and the withdrawal! I then get home and make screen prints of my online banking screens and that balances they gave me at the ATM were NOT there!!! I have even had them rearrange the withdrawals and deposits in my account to cause overdrafts!

They put a hold on transactions and make the funds unavailable to you but then drop it into the account sometimes one to five days to create overdrafts! I am sick and tired and completely livid about these unethical business practices they use to steal my money! I have already begun the transition to leave them for good and will NEVER be associated with them in any form or fashion in the future!!

$630 in overdraft fees in a 10 day period! It is less than a month until Christmas and they have stolen this money from my children!!

When I asked a phone representative about the delay she couldn't explain, but said they get numerous complaints about the web daily. You can log in and try to monitor your activity but Wachovia does not show all the transactions as they occur. Or they will change the order of the transactions even after they have posted.

I have had charges against the account cleared--and then have NFS charges appear later on. With NFS charges, Wachovia processes the most expensive items to force multiple transactions to be affected. I was told by phone representatives that if I made a deposit before the end of business day I would be able to avoid the fees; but that was a lie. I am so sick of the lies from different representatives and the lack of caring. They don't realize the inconvenience of these inexplicable fees. Yesterday I deposited a check from a World Savings account into my account which is now Wachovia. I was told that the deposit would be directly put in since it was basically cash. I checked my online account and the deposit wasn't there. But there was an NSF charge of exactly $75.00; they had bounced 3 transactions.

I went to the bank to clear this up knowing that it was their mistake and they would of course make my deposit good. NO. The deposit I made was done after 4. So the deposit I made on Oct 29 will not be good until Oct.31st, thus making more NSF charges. I called Wachovia. The representative advised me to open an account so that, in the future, should I attempt to buy a home through their program or make investments, I would have a better chance because I would already have been a customer. The representative was allowed to open an account in my name. When he asked how much I would deposit and keep in the account, I told him that I'd gotten an income tax return of about $5,000 and would probably deposit it at a later date. The representative opened an account as though I had already deposited $5000, and from that point, I was charged a penalty for the account being below the minimum of $5000. The representative had no right to open an account of that type without the minimum deposit of $5000; the account was opened with a deposit of $100.00. When I discovered I had been penalized from the inception of the account, I went to the local office. I was told there was nothing that could be done because I had not opened the account in that office. I was told to call a toll-free number to get the problem taken care of. When I first called the toll-free number, I was assured that the problem would be taken care of. When it wasn't, I called several more times and got no assistance even though I was told the problem would be researched and someone would call me back. Like many people, we live paycheck to paycheck, and cannot rely on this bank to credit our paychecks in a timely fashion with any degree of reliability. We too have suffered from their odd posting practices, to the tune of $35 each incident. Two days ago, I made a deposit of $400 cash in person. Today that deposit is still listed as pending on our online account. Though the amount is shown as available, the pending listing indicates that the cash I deposited has NOT posted to our account. Little sneaky practices such as these has me looking for another bank. I only hope closing the accounts will be less painful, though I am not encouraged by the numerous accounts I've heard from others.

It's been a snowballing financial fiasco for us. Excessive fees, long, drawn out procedures to get deposits credited (and yes, often cash deposits!) to our account. I dread signing into our online account, as I never know what trick of time they will pull next. We have now resorted to paying a $4 fee to the local grocery store to cash my husband's paychecks and pay bills with cash. This is on top of the $5 a month we pay for the privilege of having an account with Bank of America. I'm beginning to think stuffing our mattress with cash is a safer alternative, and that's very sad indeed.

I have called customer relations twice a month in an attempt to figure out why the bank chooses to hold my funds. I get different answers each time. The paycheck clears the account the same business day I deposit it, but the cash is not deposited to my checking account for nearly five days after that. Other co-workers of mine have not had these problems, so apparently the issue does not lie in the source of the funds.

My Bank of America debit card was stolen and about $3,000 was taken from my account. B of A decided to close that account down in the middle of my claims being processed which resulted in my funds being held for 2 months. Meantime the claims on my account have been resolved in my favor.

I have called Bank of America over 50 times asking them where is the $3,000 that needs to be sent to me. Every time they tell me a different story. They hang up on me several times a day and they laugh and say "oh, we know who you are". Then on top of that, they told me today that if I don't receive my check in the next couple of days I will have to wait 90 days before they reissue a replacement. I have had enough and something needs to be done.

Their logic was since I had overlooked the first charge, any charges after that couldn't be disputed with the bank.

I called the 1-800 number and got no help from this idiot and his idiot supervisor, who sounded like parrots repeating the same speel. We don't know who placed a hold on you account but you will be notified by mail. 4 days later I get a letter that states, We have placed a hold on your account. The reason given is because you have repeatedly overdrawn your account in the last 6 months.

I have a copy of my statemnt for that last 6 months and I was overdrawn 1 time and it was for a little more than $18. Now here it is the 5/22/2007 and my funds were to be posted on the 21st and the funds are still not posted to my account and the check that I deposited IT CLEARED ON THE 16th OF THIS MONTH.

I used to go and give the bank cash to pay my morgage and they said that I was not allowed to do this, that I had to write a check. Well, now I deposit the funds and I still can't write a check and the IRONY is that BOA bought up my mortgage also, so I am screwed twice.

Since that period, we have made several calls and visited two to three different bank locations, to cancel the old account, transfer my husband's bank check card to our new account, and resolve online banking issues. The deposit I made was $850 on top of the $160 that I had in my account. I had some small items come through and spent about $140 in Wal-Mart. I still had over $700 in the bank after the charges, the NSF fees and the $10 fee so you tell me whats wrong with this picture.

They tell you that the online banking is user friendly, but when you go on and check your balances and try to manage your account, you get screwd with fees. I had several debit purchases that were due to go through the account, but instead of them paying those, they chose to pay a check that would have wiped out the other 4 debit amounts and allow them to gain $140 in fees.

I called customer service to find out where the fees were coming from and they mentioned a check. Well the check was nowhere to be found on the online banking system! So I just had to take their word for it and accept the fees. They said that it will show up tomorrow and it will cost me $105 more in fees when it is all said and done! Because the original fees have caused a snowball effect. Which is what they do to make their money. I also found out that I get paid every other Thursday, but I do not have my funds accessible to me until Friday. So they sit and make interest off my money for a day! I am done with Wachovia. Then weeks later we got a letter saying the account was closed. They even charged us $60 for 'research'.

We called and found out the reason -- the lady typed the SSN wrong! We called the local branch and the customer service more than 5 times. One representative couln't find the account number and told me rudely that I need to find the correct number and call later, refusing to try again. Surely I made another call immediatly with the same number and this time the representative found it easily. I do think BOA need to hire people that can at least get numbers right. No one has ever apologized. No one gave any solution other than we going back again opening another account -- why would we? To give them one more chance to mess things up?
