Update: I reported last Nov./Dec. that Capital One paid an electronic debt on my closed account. They waited nearly a year to let me know that my $35 bill was now $210 and climbing. I was able to find help after weeks of runaround and received my letter saying that my account was closed with a zero balance. I was relieved. That feeling was short-lived. I am still getting calls and letters from their collection company even though I have sent copies of the letter that was sent to me. Now, Capital One has to let their collections company know this is real, before the collection company will accept it. The collections company sent this letter to Capital One on Dec. 14th. Almost a month later, they still haven't heard from them. This couldn't be legal? I won't even go on a rant about all the calls and horrible not-any-help people who work for this company.

We have had a personal loan with Capital One for 5 years. The final and last payment was due on Jan. 3, 2009. All payments were automatically deducted from my bank account each month. On the 3rd, I called on my account; I found the information wrong. I called on Jan. 5th and talked to a Nixon. I asked him to check on my account. He told me that I had two payments left and my balance was $462.74; I told him that was not correct. I had one payment left and he then agreed with me. I asked him why the last payment had not been deducted from my account and he told me that the last payment was never deducted from the bank account, but I should have received a letter to that effect telling me how to pay for my last payment.

I had never received such a letter and told him so. He then told me that I could pay off the balance of $462.74 by giving him my bank information and there would be no more interest or late charges to my account if I did it that way. I gave him my information and he assured me that it was paid in full and no more auto payments would be deducted from my account. On Jan. 6th, there were two charges taken out of my bank from Capital One, one for $462.74 and one for $460.49.

We called Capital One and again were given the runaround. We were told that they could not find the payment of $462.74 in their system, only the auto deduction of $460.49, and to fax our bank information to them so they could see it. We refused and said we needed to speak to a supervisor. After a 45-min. wait on the phone, a supervisor of the name, Gaylord (? could not understand him) came on. He spoke very poor English, as did Nixon. We insisted that they look and find the problem. Finally Gaylord(?) found the two payments. However, he could not tell us which was the correct amount, said he would research it and send us a refund check in a few weeks.

We are out $923.23 and still don't know what the correct amount of the last payment was. There is no real assurance of ever getting a refund. Capital One should be investigated for their business practices. We are seniors on a fixed income and the loss of the extra money has put us in a financial bind. What a mess!

I received a letter telling me my account was placed in a suspended status and would be closed 60 days following the date of the letter (12/17/08). I called them to find out what the hell was going on. They said that because I did not have activity in the last few months, they did not want me as a customer and they were reducing their extended open credit. I have perfect credit overall, no late payments with them, no delinquency, nothing bad or late or nothing. Perfect standing and they want to cut me lose. They said they didn't really know why they were closing the accounts in good standing, but they were not cutting, suspending the delinquent or accounts in poor standing.

I pay all of my bills on time; I am not behind on my mortgage or anything at all. I always pay in full and on time. Why would they not want a good customer and want to keep the bad accounts open? I have had a Capital One card for a long time and they have always been nasty on the phone, very unhelpful and borderline belligerent when you speak with them. Their overall customer service (not just the help desk) is horrible. Please propagate this underlying message everywhere you can. Notify the world of what a non-customer centric company Capital One is. Beware of this company; they will screw you one way or another! I have lost my credit card and it will show up on my credit as a bank initiated account closure which damages your credit. I no longer have that card for purchases or emergencies. The dollar value this may cost me with higher interest rates is very difficult to quantify, but you know it will cost me over time.

I just checked my Experian Credit Report today and noticed multiple credit inquiries in 2007 by Capital One without my consent whatsoever. I have never applied with them in 2007 nor at all. My phone call to Capital One didn't help as I was referred to writing in detail my dispute to a Capital One Credit Bureau Dispute Department. My understanding is that multiple soft or hard inquiries can harm your credit score. For someone like me who is trying to repair their credit, it's like sticking your foot on top of someone sitting in quicksand. It seriously jeopardizes my faith with agencies that hold my livelihood in a file.

They called me and harassed me about my car payment, which is not behind. They were supposed to do a deferment 2 years ago, but they put it at the end of all my payments. They said they would do it then. They didn't give me a time limit as to when it had to be there. I sent them $35 to do it. Then they said they would, but they didn't. The reason that I asked for a deferment was because my son was diagnosed with pancreatitis and almost died. I had to pull all my money out so that I could pay my hospital bills. They told me that I was behind a payment and they have been harassing me ever since. There is a law against harassment in Georgia. Please look into this matter for me and email me at ** with your results. Thank you.

Because of my disabilities and tragedies, I got way behind because of their late fees and other fees that accumulated to the point where there was no way to catch up. Please help, thank you. After having paid off a personal loan I had with Capital One by electronic transfer in full on December 9, 2008, my usual monthly deduction was also made. This second deduction from my account constituted an overage being taken out by Capital One. I called Capital One three separate times (December 15, 2008; December 26, 2008; and January 7, 2009) to ask about them returning my money. I talked with the customer service representatives listed above. As of January 7, 2009, I have yet to receive the excess money that Capital One has taken out of my account. I do not understand how I could have received a letter dated December 8, 2008 that said my account had been closed and yet as of January 7, 2009, I have not received the money they took from my account after the account had been closed.

Someone called to see if we could work out a payment arrangement on my account. My wife lost her job in April and I lost mine in September, so we started to get behind. My principal on this card is $495. They want $1,173.87 that includes many fees. They wanted the balance of $1,173.87. I said if I had that kind of money, we would have not been behind. They would not take arrangements from me at all under $400 installments. Now they said they are going to sue me and take me to court. I was offering to pay them $100 plus month to get paid off. Brian at Alliance said, "Too bad, no deal. See you in court" and hung up on me. Then everyone wonders why people are forced to seek bankruptcy when it is not wanted.

They closed 3 of my accounts due to non-use. They want us to use the cards so we carry a balance. I chose not to use them. Now my credit will take a big hit. Why cannot these companies be stopped or regulated from doing this? My credit score goes way down as a result and it makes it harder for me to get a good rate on other cards. It makes me feel and look like a deadbeat.

I received a form letter stating, "After conducting a periodic review of our existing accounts, we noticed that you have not used your Capital One credit card for an extended period of time. As a result, we have suspended your credit card account and will close it after 60 days." I have had that card since 2000 and have used it, but not lately. I called and talked to CSR and she told me there was absolutely nothing she or her supervisor could do. It was final, account closed, no options. Having an account for 8 years and other business accounts with them that have balances, I cannot understand why they are so inflexible. There will be now at least two consequences to my credit score: One, I have just lost a long term account; and two, I have lost X amount of available balance, which will make my balance to available balance, worse.

Who knows how many points I will lose, but this is extremely unfair considering I have managed and paid everything on time. I am considering stopping payment on my other account and throwing this back in their face when they go see President Obama and Congress for their bail out package. Congress and the Senate must put an end to this rampant pillaging of the consumer. I closed one of their accounts about 3-4 years back when they went from 7.99% to 12.99% overnight for no apparent reason other than to make more money. I would advise anyone against doing business with them and if you get in trouble with your own scenario, pay other lenders before paying them.

Wow! I wish that I had done some research on Capital One before accepting their 0% interest credit card offer. My payment was due on November 27th. I paid the payment online on November 10th and as is my practice, I kept a copy of my confirmation page showing the date and time my payment was made. The money was withdrawn from my checking account a few days later. I received my statement in early December and found that the payment had not been credited to my account until November 29th. I had been charged a late payment fee of $29 and an over the limit fee of $39.

In addition to that, I was being charged interest. I called the India office and was given the same runaround. I faxed over a copy of my confirmation to the Salt Lake City office with a letter asking them to reverse the fees. In the meantime, I paid the account down below the limit. Well, not only did they not reverse the fees, the crazy interest charge put me back over my limit and they have again charged me an over the limit fee of $39. I guess once you get ensnared into their predatory trap, it is hard to get out of without some major expenditures or ruining your credit.

I have had an equity account with Capital One for about 7 years. I received a bill in the mail every month except for the past 2 months (needed an address to mail the bill to). I called Capital One, spoke to a woman from India (who I had a lot of trouble understanding). I asked for a supervisor. She said she would handle the complaint about not receiving a bill. She never would put a supervisor on the phone. Anyway, the Capital One lady tried to charge a late fee (which I was able to talk her out of once she checked my past payment history; bills have been paid on time/before due with over the amount due going in).

The woman tried to say that they have mailed our bill to us (2 months in a row). They have not! I can say this because I have had no problems getting every other bill each month and if Capital One sent a bill, I should have received it. I got a current address to mail the payment too (which I am now saving for future use). I have already sent the payment in. It is my opinion Capital One is not sending my bills hoping I would forget to make the payment, therefore they could charge my account with late charges.

One other thing, the Capital One lady wanted my personal checking info so she could take the money directly out of my checking account. I told her I do not do business that way. She was very insistent trying to get the info. After reading the complaints listed on here, I am glad I did not give her the info. Fyi, I did a little more research and found a phone number to call a complaint into. It is the Office of the Comptroller of Currency in Washington, DC. Their phone number is #1-202-874-4700. They also have a website, Helpwithmybank.gov. I have just filed a complaint with the comptroller. Perhaps they will help in getting Capital One back on track?

When I tried to gain access to my accounts online, of course, Capital One required some information from the card itself. I have had my cards with them for over 8 years, and had cut them up a year ago. So when I called them to get the info, they couldn't provide it and told me that they would send replacement cards. I really do not want the replacement cards; I just want to have the ability to pay online. So, they offered to take a payment over the phone - for a fee. I told them a fee to make a payment is out of the question. Instead, I think I will send them 38 separate checks for $1 each so they can pay someone to sort them all out in their mailroom.

I called to find out why my credit card had been placed over to the collection department. I found out that my payment was late making my account over the limit by their charges. I called and told them that my payment was processing and I guess had not been received due to the holidays and asked that they reverse the fees so that it would come out of collections. They informed me that the only way they could do this is by me making an over the phone payment. I told them that I could not do that due to the fact that the $100 payment that I made was processing and if I gave them any more money, it would bring my bank account into a deficit and then I would have to pay a bank fee on top of everything else.

They told me that was the only way they could help me. I told them that I did not believe that the supervisor could not override the system and help me out on this so that my account was not in collections. The result in them not helping me with this issue is that I now am over my limit by more than my monthly fee and now that will result in a bad mark on my credit score which I am now trying to fix due to some other issues I had with an EX. I feel that they are the worst credit card company out there and since they are so unwilling to help someone who asks with a genuine need for it, they are just out there to scam those of us who are susceptible to the credit companies taking advantage of those who truly need or want to get their credit in good standing.

It seems to me that Capital One is a company that feeds on those who are less fortunate and that they are just out there for themselves. I understand that credit companies have to make money but at the expense of others that are truly trying to better their credit scores, etc is deplorable. I will never again use my Capital One credit card and will do everything I can to warn others. I am so so sorry that I even applied for their credit, thinking that this was a step in the direction of a new future.

The fourth month, I received a bill charging me a late fee of $39 and now charging me an interest rate of 20.99%. When I called to complain, they could not wait to take me off the phone and cancel my account because I was not spending enough money with them. I am on the verge of starting my own business and with these hard economic times, I would think any credit card company would be happy to have such a reliable client who always pays their bills on time! I have been unfairly charged overlimit fees on the same purchase. On November 28th, a single purchase of $113.00 brought my balance over by about $70. An over credit fee of $39.00 was immediately charged. When I paid my November balance, a minimum payment was shown of $40. I paid more than the minimum, however, I did not see on the payment page any further amount due. My next statement charged me an additional $39 over limit fee. This is for the same overcharge that I have been penalized for.

When I called the company, first the employee refused to connect me to a manager saying that they would explain the same fee procedure. When I insisted, the manager refused to credit me for the second over limit fee. There is no need, according to them, to show the correct amount due. I have other credit cards and if there is an overcharge, it immediately shows on the payment due. I believe I should be credited for $39.00. This company needs to improve their system of online information so that a customer in good faith, making an on-time online payment may know the amount due that avoids any unnecessary and duplicate penalty fees.

Some time ago I had three credit cards with Capital One. Due to disability, I became unemployed in January of 2004 and was unable to work for eighteen months. The cards went into collections and were charged off in the Summer of 2004, with the resultant impact on my credit. That's just my tough luck. However, Capital One makes a habit of re-reporting those charged off cards to the three credit reporting agencies every month. There is no need for Cap One to be doing this because there is no new information on any of those accounts since they were charged off over four years ago. The problem is that Capital One's habit of re-reporting the accounts harms my credit.

My Experian FICO score, for example, dropped forty points last month and my identity theft protection service explicitly told me that it was because of Capital One contacting Experian and saying essentially that this is still a bad debt from four and a half years ago. Since I was able to return to work in the summer of '05, I've been working very hard to get my life back on track. Rebuilding my credit is obviously an important part of that and Capital One's behavior is preventing me from doing so. All my FICO scores are still in the bottom five percent in the nation because Capital One keeps knocking them down. I almost feel like I'm being held hostage.

I signed up for a cash back Capital One account on their build your own credit card site. The card promised 1.25 points for every dollar spent. This sounded like a good deal, so I signed up. To my surprise, they played a slight of hand on the amount of points needed to get cash back. Most cards provide $100 for 10,000 points; however, this card only provided $75 for 10,000 points. So they provided the illusion of getting more points, but actually provided less money back. To add insult to injury, I was charged numerous fees after missing a payment deadline by 2 days. Since I always pay my balance in full, I was more distressed to learn that they would only refund the late payment charge and would not give me a break on the interest charge.

Then due to my own foolish mistake, I double paid them on the closing balance - once after closing the account and again a few weeks later when I received a statement. I just found out that the refund check will be sent within 30 business days. I tried to complain to a supervisor to no avail. They owe me in excess of $1,000 but will receive an interest-free loan for over 30 days! I told them I'd like to charge them 14% interest for the money they are taking from me, but they had no reaction to my comment. Needless to say, I will not use Capital One again.

I had opened an account with Capital One many years ago. They allowed unauthorized charges on the account, which led to my account being maxed out and I was not gonna pay for something I did not do. I received a summons from a man that came to my door yesterday. It claims that the attorneys Farrell and Seldin are suing me on behalf of Capital One. The summons looks like it is from the second district court, but there is no court date on it and there is a page contained in it that says If you owe the money and would like to arrange to pay the debt, please call our office prior to the Court Date. This may avoid the necessity of you appearing in Court. The telephone number is 1-866-796-8300. This is an attempt to collect a debt and any information obtained shall be used for that purpose. This communication is from a debt collector.

Now, as far as I have learned from the Fair Debt Collection Practices Act, it is illegal for them to do this to me. In 15 USC 1692e it says that "The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to it's source, authorization, or approval.

I made two payments on my account in November, one for $239.77 Nov. 5th and one for $252.62 Nov. 19th. When I got my statement at the end of Nov for a $7.25 balance and a $7.25 minimum payment due Dec. 17th I ignored it because in my mind, I was paid ahead. Boy, was I wrong. They immediately slapped a $39.00 late payment charge on my account and then Dec. 26th started calling my house with courtesy calls telling me I needed to make a $52.32 payment. I tried talking to this man but he was from India and I could not get through to him that I had paid my payment early. He just kept saying you have to make a payment. I finally told him ok I would through my bank.

I sent Capital One $75.00 through my on-line bank. On Dec. 29th, I get another call while I'm in the shower. At first it is a recorded message stating that I had a late payment and that I had promised to make a payment and I had not. Finally a person came on the phone wanting me to verify account number etc. I tried to tell him that he (again from India) I was in the shower, I was not going to verify anything, that he had called me and that yes, I was the right person. What do you want. He said he could not hear me. At that time I hung up.

I called the customer service number back when I got out of the shower, immediately goes to India again. The representative says he can't hear me. Hang up and call again. This time I get an English speaking person on the phone. I ask the representative why all the phone calls over $7.25. He says he wants me to pay $52.32. I told him I had paid $75.00 Friday, he said he don't show that yet. Well, my bank shows it was deducted on Dec. 26th. I told him that I had made the two payments in November and had never been late with a payment before. He said you can not pay early on your account, but if you do not pay your minimum on your bill each month even if it is only $1.25, they will charge you $39.00. (WHAT A BUNCH OF BLUUEEE)

Seems to me that is double jeopardy. They are charging me $39.00 for not making a payment, then calling me to pay my January payment as it turns out for $52.32 in December. Want that cause me another $39.00 when they don't receive a payment from me in Jan. because I paid it in Dec. I am closing this account. I have been with them for years and this is no way to treat a customer. They are making me feel like a criminal.

Today, Dec. 30th when I received my Jan. statement, there is a big message on top of the statement that say, "Whoops you're behind by 1 payment. IT COULD HAPPEN TO ANYONE, MAKE SURE YOU PAY THE AMOUNT DUE ON YOUR STATEMENT AS SOON AS POSSIBLE." The amount due on my statement is $52.32 with a due date of January 16th. I'm so sick of being treated like a criminal. That, I will close my account.

In August of 2006, I paid off a balance of $5000.00 dollars on my Capital One card. At this time I discontinued use of the card. In November of I told the company to close my account, because I was dissatisfied with the way they did business. I assumed that the account had been closed, and I did not receive any more statements from Capital One, only offers for more credit. In April of 2008, I received a call from a company (don't recall the name) asking to verify a purchase of over $2000.00 dollars. I told them that I had made no transaction and that the account should have been closed. They told me to contact Capital One and find out what was going on. I did so and spoke to a lady who took all of my information when I explained what had happened. She was very helpful and I thought, "That was easy!" Well to my dismay I began to receive statements from Capital One asking me to make payments on the balance which was almost $12,000.00 dollars.

I contacted the company again and was assigned a Mr. **, to help me with the case. It took me a little while to gather all of the evidence that I had to send to him. It took a while to research through what paperwork I had. As I examined the purchases I saw that there were repeated purchases, 3 times in one day to the same Target store, usually around the same amount, a little over $300.00 dollars each purchase. This was done over and over for weeks. Including a major purchase for over $2000.00 dollars. I was never called from Capital One to verify this crazy pattern of buying. Nor did I receive any invoices to the effect. And, I never received any kind of response from the person supposedly handling my case, even after repeated letters to him.

The weeks went by with no response from anyone. So I called again, and again I found that no one had done anything. And again I was asked to give all of the information that I had. It took another couple of months before I heard anything from Capital One. This time I received a statement with an amount of $5,810, and again I was asked to make payments. The crazy part of this is that I never received any kind of invoice up until the time that I reported the fraud. And, also like another person on this site commented. Whoever committed the fraud, that person was also making payments, which I never received or have seen. That person also raised my credit limit and got a pin number to withdraw money from the ATM. I don't know how this was done, because I still have the old card in my possession. I cannot believe that so many people have had similar experience with Capital One and with the same outcome. This is very very wrong. A major investigation needs to get started.

I got a letter in the mail last November saying that I had been pre-approved for a Capital One credit card. I used the card but didn't charge up to the limit. The first bill I received it was over the limit due to a membership fee, and then an over the limit fee. This is where it all began!! I lost my job and was not able to make the payment on time. But I did make the minimum payments they had listed on the statements (when I received a statement). Some months I didn't even receive a statement and had to call to ask. The excuses I received was wrong address, statement late going out, etc. The harassing phone calls began every day beginning at 8:00am till 9:00pm at night.

This November my grandmother began helping me out to get this paid off. She called and made a phone payment but the manager in Canada left a number off her checking account and the payment was returned due to invalid account number. My account was charged for the payment amount, a returned payment fee, and late payment fee. We were able to get the late payment adjustment taken off but they refuse to take off the payment amount she had made because they claim they didn't receive it even though we have proof on the statement they did receive the payment after my grandmother called back and gave the information again.

We have talked to customer service in India on numerous occasions without resolution and although we have talked to a couple of decent managers for the most part they have lousy CS skills. We are writing a letter to CEO Rich Fairbank. Now they have suspended my account. But I haven't been able to use it since the first month I have had the card with them. I think something needs to be done about these people and what they do to others.

I have credit cards, and have been having complications for a while now. I have been attempting to deal with this company on my own and it is getting more difficult. They latest issue is that I entered into a Hardship Agreement with Capital One, on their terms, and I held up my end, however they did not abide by their own terms of the Agreement. I have tried to discuss these issues and get the accounts corrected. I have been told that my accounts would be escalated to supervisors, and that the supervisors would be calling me.

I have been expecting their call, but this morning, a collection agency called me to collect on the debt. I have not had a call from a supervisor. I also found out today that the representatives that I have dealt with have not been documenting properly, therefore I feel that my rights are being violated, per the Federal Credit Reporting Act. Capital One has been fraudulent with dealing with my accounts, and it is now affecting my credit as well. I am being negatively penalized, because of the actions of Capital One.

I do need an Attorney to help me, please. I am fighting to keep my head above water here, per se. I do not want to have to file Bankruptcy because of Capital One's poor business practices. I feel that they should be accountable for their mistakes they have made. Not to mention the lack of communication on their part. I appreciate any assistance that you may be able to offer me regarding this time sensitive matter.

I called about it and it was obvious they didn't care and no longer wanted my business. They did suggest that I reapply for a credit card. That does hurt your credit and it is unfair for them to penalize you for being responsible.

They could have given notice. It will penalize you for having a new account and for the inquiry. I need to do a refi soon and will have to have this inquiry and now I will have to open a new credit card for emergencies but I won't use Capital One.

The person I spoke with said I should wait another week to see whether it gets posted. If not, I should cancel the check and courier a new one (by this time it was 8 days late). This is what I did and I had the check tracked by the post office. The post office said the check was delivered on the 12 of December, it is now the 28th and it still has not been posted.

After speaking to about 5 other individuals from Capital One, I asked to speak to a supervisor at which time I was told a supervisor would be calling me with 7 days. I tried to make a payment of $200 and it wouldn't accept anything less than $239.40. I called customer service and was told that you can only make the minimum payment amount on the website. I asked them how much I had due and they said $160.34. So I asked why does the site say $239.40 and was told that was what I contracted to pay each month and the fact that I owed less than that this month means I would have to find another way to pay. This is crap.

Their site tells you you owe more than you actually do and won't let you make any payment under that amount no matter what your actual amount due is. I pay more than my monthly payment each month, so my payment each following month is lower and lower than my actually scheduled payment. How can this be a bad thing? HIGHLY unethical, shady company. In march of 2008, I paid off the existing balance, and the check was issued by my Credit Union, marked as PAID in FULL. This did not stop CO from continuing to bill me. They claim a charge was placed after the pay off date. I DID NOT authorize this charge, and told CO that fact. They have called me for to twelve (12) times per day, everyday for nine months. I have told them repeatedly to clear their books, correct the error, and stop calling and they refuse to stop or take any corrective action.

NOW, they put a nasty gram in my credit file. Considering that many of the callers do not speak English well. I thought it might be a failure to communicate, but after talking to some customer service (as in farm service), and being told twice that they would fix the problem, I have come to the conclusion that they are idiots, cons, and mindless fools. Anyone who gets a CO credit card is made a victim of incessant promos, calls, increased rates and rip off fees that amount to much more than any charges. TWO supervisors of Capital One have told me they see the error and that it would be corrected, but have failed to make it so. ONE told me I would get a check from Capital ONE for the overpayment. It never got here. They have lied, cheated, and ignored basic rights to NOT be harassed for a debt that I did NOT make, nor was it done on my behest.

I received a letter that my account was to be suspended since it had not been used in a long time. I had not used it due to previous problems. The letter said that there was a Rewards balance to redeem that should be done before the account was closed. I called today to try to redeem the Rewards. The first time, I spoke to Customer Service, I told them I did not have the full account #, but they were able to pull up my account without it. I did have the last 4 digits of the account. They said I needed to call the Rewards Department and they would send over the account information. I called the Rewards department and they said that the account was not sent over and they did not have the account numbers.

So I went through the whole process a 2nd time and called Awards again. This time they had gotten an account, but it was the wrong one. The 3rd time I called, they connected me with Awards and after a long hold, I got someone who said they would transfer me to a supervisor. I was on hold for 20 minutes and then the music stopped, and I got the beginning of the menu, please enter your 16 digit account # and got transferred back to Customer Service. The 4th time I tried and finally got a supervisor in Customer Service, but once I got back to the Awards department, I could not get anywhere. This time, after a long time on hold I just got disconnected.

I tried a 5th time (now 2 hours on the phone) and the Customer Service Supervisor transferred me to the Awards department and after a few minutes of silence, then a few minutes of music, I got the beginning again of the recorded message to enter my 16 digit account #. It is such a scam. Customer Service could look up the account and tell me I had 10,000 miles, but only the Awards can redeem the mileage - for miles, or cash, or gifts, etc. But when you call the Awards redemption Department, they tell you they cannot find, or do not have the account information. One supervisor on the 4th or 5th call said in a rude way, "Let me tell you how this works" as if I was an idiot. I guess this is their way not to allow you to actually redeem any rewards while telling you you have them. After reading other complaints, I only hope that this has not effected my credit rating which has always been very good. I will never do business with them again.

I received a pre-approved office for a Capital One MasterCard in the mail back in November of this year. It was for a 0.0% APR introductory rate for the first year and 6.5% APR each year after. I went online and filled out the form on their website and after submitting the form online I received a message advising me I would be notified by mail if I was approved. For the next several weeks I did not receive anything from them.

On December 11th I received a call from Capital One asking why I have not activated my new card. After advising them I had not received a card, or a letter telling me whether I was approved or not, they canceled that card, listed it as lost or stolen, and said they would send me a new card in the mail. On December 18th I received my new credit card in the mail and promptly activated it. I then made two purchases using the new card which posted to the card on the 22th. On December 23rd I attempted a very small purchase and was declined.

When I called Capital One they advised me there was a past due balance on the card and a payment was due on December 16th. I attempted to explain that I never had the card until the 18th and their own records would show that. I also advised them I did not use the card until the 18th which was two days after the due date. They advised me the charge was the annual fee and I needed to pay that on the 16th. Several times I tried to explain that I could not have known about the charge since I had never received a bill or the card, nor did I even receive a letter telling me whether I was approved or not. They did offer to waive the late fee.

When I arrived home later that night I promptly executed an online payment. I noticed that the late fee was not waived. I called customer service who again said the fee was waived but my APR was now 6.5% because I violated the terms and agreements. I went through the entire explanation several times and asked that I be restored to the 0.0% APR. They refused stating I should have paid them by the 16th. They offered to lower the APR to 0.0% if I make 12 payments on time.

Their own records showed all of this but they still refused to go to the original terms of the 0.0% APR. I requested the account be closed and after about 40 minutes of arguing they finally agreed to close it. (The entire phone call was close to 1 1/2 hours.) They are still going to charge me the annual fee even though I am not using the card for the year. I requested a manager and the operator just kept saying that they will tell me the same thing she did. Her operator ID number was ** (just in case anyone from Capital One is reading this). She finally agreed to transfer me to a manager and after the phone rang for 7 minutes straight without anyone picking up, I finally gave up and had to hang up. I have/had a CapOne credit card which I had been paying off in full every month since I got it several years ago. Things got rough for me financially and I decided that I would call each of my creditors to work out a deal to lower my interest rates. No one was willing to budge. As a side note, I find it highly ironic and hypocritical each one of my creditors willingly asked the Federal Government for BILLIONS in bailout money, CapOne having been the recipient of $3.55 billion. So, as the debt started to mount higher and higher, I decided the best thing for me to do was call a counseling agency to help me get a handle of my accounts and payments. They successfully negotiated a 4% to 5% drop in interest rates for each creditor EXCEPT Capital One who is still taking their sweet time on my proposal weeks after the proposals were sent out.

The calls from CapOne collections started and I informed the employees who called me that the debt had been turned over to the agency, payment was made in early December. Collections, being the wonderful people they are, refused to hear me and told me that according to their records no proposals had been approved and I must pay on the account. I questioned each individual I spoke with, "Has it at least been received?" They are never able to confirm this information and they are unable/unwilling to transfer my calls to the person/people/department responsible for reviewing such proposals. "If it has been received, it would be in my system." During each call, I asked the representative if they would escalate my call to a supervisor and each time I was told there are no supervisors. In fact one collections guy went so far as to tell me, "The buck stops here, sir?"

Finally, during the sixth or seventh call I made, I was able to speak to an account representative other than collections after I pointedly told the collections guy that what he was telling me amounted to extortion under US law and that my attorney would have a field day taking CapOne down. The next person I spoke to was just as relentless about me paying money to them as she was adamant that no proposal from debt counseling had been received, yet she was very forthcoming with respect to admitting that she couldn't even tell me if the proposal had even been received and could just be sitting on someone's desk. At this point I gave up, but it's not the end. I won't allow these people to bully me or treat me like I'm some criminal over a $100 fee.

Lo and behold - I get a call early over the weekend saying I was 13 days late on my payment. I tried to explain this to the person from India, but he didn't want to talk to me until I gave him a payment. I told him that I would call Customer Service on Monday morning to get the matter straighten out. Monday morning was absolutely terrible. The supervisor from the US said he couldn't allow the deferment until he received a payment and, he said he didn't see any fax. Additionally, he wouldn't allow me to speak with his boss. He said he's not obligated to let me speak to his boss. Once I pay them off, I will never deal with Capital One again. They are very deceptive, and I just hate to see the interest they will tack on. I honestly hate Capital One and I can't stand the people who work there.

I noticed 2 adjusted payment charges on my account, one for $800, and one for $126.00 (not to mention the $39.00 over the limit fee). I have been unsuccessfully calling to find out the nature of the charges, to no avail. No one can tell me anything except it was used in the form of one of those checks that they send you with your statement. I never use those, the interest rate is too high. Apparently, this type of transaction is to complicated for the normal customer service person, and after going thru the regular phone number, and answering questions like, "do you intend to make a payment to bring your account current?" Every time they left an auto message, "Hello, this is Capital One. Please call..." blah, blah. Then I would call, it would say, "Please enter your ten-digit card #", Like I even had a card #. Highly irritating & harassing. A CS rep from cell contacted them (he must have made a # up) & the woman was very rude! She was like "What's your account #, ma'am." in a snotty voice. I was like, "Quit harassing me. You have the wrong person." They said this is collections (no, really?) and she transfer me to customer service (or so she said) and no one ever picked the phone up. A few years ago, my mother passed away as a result of medical malpractice. And as a result, I began experiencing depression and health issues. I had proof of my illnesses from my doctor and was paying for insurance on my Capital One account just in case I could not pay for just this type of situation. The problem began when they were denying I had the insurance even when it was clearly marked on my bill. Then when someone did finally acknowledge the obvious and the insurance company agreed to pay, some idiot turned the matter over to a collection agency.

That's where things get real interesting because I can't tell if the insurance company in fact paid the debt or not, because my account was locked online and when I try to call them, I am instantly transferred to the collection agency. Then I find out from the collection agency that they aren't allowed to contact Capital One, even to verify if the debt is still valid or the status of the payment. I was then berated to prove what I was saying when Capital One had not sent me anything nor the insurance company because my account is frozen. I did manage to reach the insurance company who likewise found Capital One would not reply to them about the matter and their own records indicated that the payment was attempted, but there was no data in relation to completion of the payment because that unfortunately comes from Capital One.

Since then, I have been harassed endlessly by the collection agency working on their behalf and one agency actually abandoned their attempts to collect because they felt in good faith that I was being honest with them, and that I had in fact attempted to pay the debt but with no way for them or me to communicate with Capital One, we could not proceed further.

The abandoned collection efforts were then picked up by another agency which didn't care one bit to even discuss the matter and in order to even try to get a word in edgewise, I had to almost scream at the top of my lungs to talk over the woman who acted more like a machine than a human being. I have severe health issues that have deprived me of my ability to work, and made the mistake of saying how my friends were trying desperately to help me keep my phone and electricity while I fight for disability, while they themselves are unemployed or struggling and the collection agent took that to mean I can pay them and immediately began demanding I get them to help me with this when they're doing the best they can to keep me from freezing to death and to have a phone in case of a medical emergency. Then to top it off, they threatened that Capital One is a multi billion dollar banking institution, I did not want to have this matter go to court over, and to accept a settlement offer or else when I desperately tried to tell them I couldn't.

Being harassed by companies like Capital One for payment their own incompetence prevented from being made is one reason I keep my phone unplugged except for an emergency. Unfortunately, there's a freak winter storm and I left the phone plugged in because people were calling worried about me and I did not want them on the roads coming to check on me, because the roads were iced over and numerous accidents were happening. They like to ask What's In Your Wallet? Maybe they need to stop asking that, if they aren't willing to hear the answer...there's nothing in my wallet.

Capital One has a system set in place where every effort is made to block you from communicating with them should anything go wrong with your account. Anything including their own employees making mistakes when efforts to collect payment are being made by customers. Their insurance providers are not the issue as they were pleasant to work with and went out of their way trying to get the payment made, working with me until Capital One turned the matter over for collection. I don't know what kind of business would make these type of mistakes, and then block all means of communicating with them including their own collection agencies.

But if I found out my employees turned a matter like this over for collection, when their insurance provider was about to pay a debt they knew I had no money to pay, I would be more than a little concerned that there were major problems within the corporate structure that needed to be addressed. But how will they ever know when anyone who runs into major problems with the system and who tried to pay is blocked from all means of communicating with them. This is how a criminal organization would operate.

I have a Capital one Credit card. It had a $3500.00 limit. I maxed it out and paid it off before. This last July, I reopened the $3500.00 account. Work was slow and my wife's kids were visiting from California and we needed for them to have fun. I ended up maxing out my $3500.00. My payments were $109.00 a month. I made a couple month payments. Then all of a sudden I was over the limit and my new loan amount was $3250.00. I started to get dinged with $39.00 late fees and $39.00 over the limit fees. I called Capital One and got India or the Philippines. I wanted them to put my limit back to $3,500 and take the fees off. This went on for another month and I told them work got slow and I wouldn't make the payment until they fixed the wrong they had done me.

It is now 3 months later and I need to pay over $600.00 to become current. I don't have a problem paying the $109.00 starting Jan 1st if they knock off all the wrongdoings they have done to me. I've tried numerous times to call and talk to someone in America. When I finally did get a hold of someone in America, they told me I had to come up with over $200.00 by the next Friday and even that wouldn't make any set promises or deals. In my view, this company is a huge scam and I've decided unless they make good to me what they have done me wrong, I will just let the card go and not give them a red cent.

As each month goes by, that amount to become current gets higher and higher. Work is slow and we are on the verge of losing our home. I can't come up with the kind of money they are stealing from me. The people are rude and I get harassing calls everyday. I'm willing to work with them, but so far they are willing to do nothing for me but steal from me. So I've decided to let the bill go to collections. Worst case file for bankruptcy and they won't get a dime. I told them that. The operators overseas goal is only to collect the debt. If you are thinking about getting a card from them, think twice. I wish I had. Now my credit is in for it.

They are the lien holders of my vehicle. I have experienced some financial set backs. When several days late on a payment and receive the initial calls, when I speak to the customer svc person and explain the situation and give a date and amount of the payment, the comment that is made a note will be made and the call ends. After 10 minutes another call comes in and it's another customer service rep. with the same speech. I asked if they read the contact log that was entered and that I've just spoke with someone. They answer yes, but say we will continue to call you until a payment is made. And the calls will keep coming in every 20 mins to an hour. Until I get someone will knows the law of only contact the debtor one time a day. They don't leave a message on the first or thirteenth call of the day. Their explanation is they have to speak with someone before the calls will stop. When they do speak with me, the calls do not stop.

I communicate with these people and whatever I state to them is not sufficient enough in their eyes, because who ever makes the initial call and get a payment, of course gets a percentage. I know how it works. It is harassment. I spoke with a customer rep. the week of Dec.1st 08, and he was very nice and explained to me that by the following weekend my account will go in to the repossession dept. The date he gave me was also the date I would make a payment. He did explain the call would not stop until a payment is made. I advised the vehicle I received was a lemon, sort of speak, because a month after I got it, problems arose. Even though the extended warranty was provided, I still had to come up with money. And it was money to pay for my monthly payment on the car. And to date there is additional issues with the car.

It is very stressful communicating with a company although you owe and they constantly call and coerce you in to promising something you know you can't, but you will try your best. On Dec. 8th I received a call at home from them and I explained my statement will not change. I will try to make a full payment or half on the 12th of the month. It was the same person who called me that Saturday before and four other calls came there after. Because she didn't like my tone and responses, after stating she will go to her supervisor to see if it can be approved for them to accept my promissory payment on the 12th, she came back and stated if I can't make a payment over the phone, now they are coming to get the vehicle. I replied to her, "Do you expect me to give you bank information over the phone, with no money in the bank until the date I informed would be available, to be in more trouble with you as well as the bank."

She replied I can request a pre-date and it will not go until the date I asked. I told her, "No I will not do that." The last time I experienced that, they didn't hold their end of the agreement and cause an issue with my mom's account. I was told when it is in the status, I can't make an on-line payment. After completing the call because it wasn't going anywhere. I went and made an on line payment scheduled for Dec. 11th. And it went through with no problem. The other issue I have with them is the privacy act. When they call the house to speak to me and I am not available, my mom is answering the phone and they ask for her. She is not a co-signer on the account at all. The phone is in her name and she is very annoyed with them. Call on the weekends from 8am to 1pm and late at night during the week.

In August 2008, I applied for a credit card with Capital One. I received correspondence from them requesting me to mail them a copy of my Social Security Card and Driver’s license, since they could not verify my information. Since I still had a limited credit history, I accepted the request as reasonable and mailed the documents. About a week later, I received another letter confirming the receipt of the previous documents, but indicating they also need to verify my address, and I need to send a copy of my utility bill as well. A bit annoyed for not being asked to send this with the first mail, I obliged and sent them a copy of a recent utility bill. About another week later, my new capital one credit card arrived in the mail.

After using my card for +/- 3 weeks, while making a purchase at a coffee shop, I had to face the embarrassment that my card was declined for a $5 purchase. I phoned Capital One, only to find out that a restriction was placed on my account due to “suspected fraud”. I was requested to send a copy of my SSN card and driver’s license before the restriction would be lifted, since they needed to verify my identity. I was incredibly upset by this, since I supplied ALL this information when I opened the account less than 3 weeks ago. But I was faced with Capital One’s fraud department who just refused to help (they said they had to assume they were not speaking to me until I sent them the documents).

So after battling with one of their agents and his manager for about 45 minutes, I gave up, and faxed the documents. I was promised that the restriction would be lifted within 24-48 hours. Needless to say, 48 hours later, account still restricted, I had to get back on the phone with Capital One. I was now told that they again needed to verify my address! I was even more upset with this but the result was the same as with the previous call, so I ended up faxing them the documents. The restriction was lifted the next day.

About a month later (October 2008), Capital One sent me a new card with a higher credit limit. Once again, after using the card for about a month I, by chance, saw on my online banking that my new card was restricted!! I nearly exploded - again not even a phone call from Capital One to warn me. So, on Thursday, November 20th, I had to face up to the Capital One Customer Service again. Same story: I had to fax a copy of my SSN card and driver’s license and wait for 24-48 hours for them to process it. I was again “helped” by an agent who refused to expedite the process in anyway, and because the documents I sent earlier were for my other card, they did apparently not count.

After explaining my unhappiness during a 45 minutes call, I just ended up faxing them a copy of my SSN and Driver’s license. This time just with the additional problem that my payment was due on the 29th, and I was unable to even pay my account online. I was told by the representative to mail a check, in order to avoid late payments. I did however not have my checks with me and felt that this was a rather unreasonable request, seeing that I did nothing wrong to have my account restricted in the first place. But augmenting with Capital One seems a waste of time.

So on November 20th, I faxed the documents, as required to Capital One. Monday, 48 business hours later, I received a call from Capital One saying they received my documents, but needed to again verify my address. I refused to accept this, and asked that the account be closed, since I did not accept their way of treating me as a customer. I was told that they refuse to do that, until I send them my latest utility bill. Again wasting another 45 minutes of my time. I ended up faxing my utility bill to them.

On Tuesday, I phoned them AGAIN, hoping that they would’ve perhaps processed my documents, but was told that an agent will phone ME within 48 hours to tell me that the account restriction has been lifted. But on Wednesday afternoon, I have not heard back from them, so I phoned AGAIN. I was then told that it was still not processed and can take up to 72 hours!!! This was the first mention of this and completely different to that what I've been told up until now. Again a complete refusal to expedite the process whatsoever. Now it is November 30th.

No word from Capital One. My account is still restricted. I had to pay $10 to do a balance transfer to my Bank of America credit card to avoid late fees and negative credit reporting (although one lady told me they would take it into account, another told that I was responsible to get it sorted before the due date). I am extremely frustrated and really disappointed that Capital One is allowed to treat a customer like this. I will definitely not recommend anyone to ever do business with them.

I have been a happy Capital One customer for many years. I have 2 Capital One credit cards - on which I usually pay off the full balance each month. I now wish to register an official complaint.

Almost every month I receive those checks in the mail - pay off higher interest rate cards, write a check to yourself, etc. I never did... until the beginning of November 2008. The offer was for 0% APR for 18 months. I called to confirm and ask questions about this offer. It seemed like a good deal. I was told that I could write a check to myself - I would be charged a small fee for the processing and would receive 0% financing on the balance for 18 months as long as I paid the minimum amount each month.

I got my bill - there was the "charge" for the "access check" for $3,000.00 (I had used the $ to have blown-in insulation installed in the walls of my home to try to lessen the amount I pay for heating during the winter months). There was also a charge for $60.00 listed as Special rate offer FINANCE CHARGE. I went online to make a payment (my total debit balance was now $3,505.17) and I didn't know how to pay the "purchase balance" amount and some towards the $3,000.00 access check amount so I wouldn't risk losing the 0% APR on the $3,000.00. I called Capital One and was told that all I had to do was make the minimum payment to my account. The "access check" was now part of my balance. I told the person that I always paid off my "purchase balance" as I don't want finance charges and explained that I wanted to do that.

I was then informed that any amount I paid off would be applied to the "lowest" APR figure or what was to "expire" earliest. This meant that if I paid $800.00 it would all be applied to the $3,000.00 "access check" balance. (I would still have the $505.17 debit, $60.00 of which was for the "FINANCE" charge for the access check which would be subject to the regular APR rate). I could not segregate the amount I was making a payment on. The conversation continued with me trying to qualify that if I made a partial payment of my total balance I would be charged finance charges on any unpaid balance, which would be the "purchase balance", which turns out to carry an apr of 23.92%. I was extremely upset and I asked to speak to a supervisor and was told that the supervisor would tell me the same thing - any payments made to the account would be made in the same "order" - $ first to the "access check" balance, then to any remaining balance. I thanked the person and hung up.

After thinking it over I called back and got someone else. I explained it again and was told the same thing. I was extremely upset and said that I certainly hoped that the call was being recorded (as the automated message tells you at the beginning of the call), because I was going to call back to speak to someone higher up. The person on the phone apologized and said that before he said "goodbye" that his supervisor wanted to speak to me. A "supervisor" came on the line. I went through the whole scenario again - he asked me to hold a moment - I did - he then came back on and told me that as long as I paid a figure that would bring the balance down to $3,000.00 or less I would NOT be charged any additional finance charges.

I asked him why 2 other people from his organization told me a different story. I asked which story I was supposed to believe. He then paused (he was reading something) and when he began speaking again he told me that the "original" story was correct, not the one he had just told me (this from a supervisor). I would be charged the high rate finance charge on any balance outside of the $3,000.00 if I did not pay off the entire balance on my account - they could not apply my payment to my "purchase balance". I informed him that I was going to pay my entire balance (which defeats the whole purpose of their offer of 0% financing for 18 months - which I should have known was too good to be true - the least they could have done when I called to inquire about the "deal" to begin with was to tell me to make sure I didn't have any balance on my card and not to use the card until the "access check" is paid off) and discontinue use of the card. I then asked him that when my entire balance was paid that I wanted the $60.00 FINANCE charge credited back to my account. He told me that it wasn't really a FINANCE charge (even though that is what it was listed as on my statement - in 2 places) but a charge for writing the "access check".

I am also going to write a letter to the President of Capital One complaining about the deceitful business practices and unreasonable way payments are credited to accounts. I believe this whole "access check" business is a HUGE SCAM and these Banks should not be permitted to continue this practice. My whole purpose was to have 18 months at 0% APR so I could lower my heating bills, and try to get ahead. I have an excellent credit rating(in the high 800's), have never declared "bankruptcy" - pay all my bills in a timely manner. I do not contribute to the "failing economy" and take advantage of the "system" as many others do.

I'm sorry if I have "run on" but you did ask "what happened". I don't know if writing this will solve anything - if nothing else it allowed me to vent. (I started my day with this at 10:23 am - it is now 10:30 pm - what a frustrating way to waste an entire day). Let me know what, if any, outcome there is or what other recourse I may have.

The address I send my payments in to is: Capital One Bank, P O Box 71083, Charlotte, NC 28272-1083 but the "official" address for Capital One headquarters is: 1680 Capital One Drive, McLean, VA 22102; phone # 703-720-1000. If it is at all possible - when you respond to this "book", could you please include a copy of what I have written here? (I'm on a laptop with no printer). I thank you in advance for anything that can be done.

I received an offer in the mail for a 0% credit card for balance transfers from another higher-interest card, which said I could apply by phone or online. I applied online, but there was no place in the online application for me to enter the reservation # and access code that they provided in the offer letter. Nonetheless, I thought I had applied for the same card referenced in the offer letter. When I got my first statement, I realized it was not the same card, and I had instead applied for a card that had 0% on purchases and 9.9% interest rate on balance transfers.

I called Capital One to explain this was not the card I wanted, and that I would like to cancel this card and transfer the balance to the card I was offered. They said they could not help me because I had already accepted the terms of this card. I explained that if I could not move this to a 0% card then I would pay off the card now and cancel my account. They still refused to help me. I have never before had a credit card with Capital One, and I will never again open a card with this financial institution as I feel their customer service is extremely poor compared to other banks. I was charged $122 in finances charges that they would not reimburse, for a card I did not want.

When I called to inquire, they said that unless I pay after my statement is released on the 5th of the month, the payment is credited to the previous month and hence a late charge. I pointed out that I was actually prepaying each month and they were then assessing a late fee. While they were willing to remove the late fee for two months, they still won't accept my payment before the 5th of every month.

In January, 2008, I started contacting the Capital One dispute department regarding charges totaling $2,050.00 for an upper denture and lower partial made by Auburn Dental Associates in Auburn, NY. I was told that all I had to do was write a letter telling of my reasons for filing the dispute and the amount. I waited until May 2008, to file the dispute as I wanted to be fair with the dentist. The dentures did not fit. So bad that my gums would bleed.

I supplied every item that Capital One requested - two if not three times. I talked with 16 dispute department employees and was told something different by each person. I was told that I would win my dispute (this was by two employees). That the dentist had broken compliance with their credit card company and I would win for that reason. I was told to take the dental hardware in. I did not want to do this but deferred to what I thought were reliable dispute department employees. I was told by a woman named Pamela that I should write a letter asking for a reopen appeal and state in the letter she had instructed me to do so. She told me we would then address the rude supervisor that I had encountered.

Pamela gave me her employee id #. Pamela told me she would call me the next Friday to let me know if my faxed letter had arrived and the 42 pages of documentation that I was submitting for the second if not third time. Pamela did not call me. I was not able to reach Pamela again - she was always away from her desk or unavailable. The first supervisor I talked with was very rude and told me, "Maybe you do not want to talk with me then" when I was sharing my frustration with the dispute. The second supervisor told me that even though I had provided everything Capital One had asked me to, my dispute was closed because I had not provided everything. She even told my husband this.

When I called the 800 # to find out who I should address my letter to at Cap One filing a complaint against the dispute department, I was told to address the letter to the DSO Department. I received a form letter back from Cap One: "Thanks for contacting us about a charge on your Capital One account. We looked into it and found that we've already responded to this request. We've enclosed that correspondence for your records. We consider this case closed. Unfortunately future correspondence will not change the outcome of this dispute......."

I attempted contact Capital One as I picked up another job to help get caught up and they turned me to a collections agency that told me if I made three payment of $230 each over a 7 week period that I would be able to bring my account current. I told them that would not be possible and they told me that would be my only option. I offered a message on their online message center indicating I would be happy to pay a reasonable amount in these charges on Nov 14 . I have not received anything back from them. I just recently read a book that indicated they were very difficult to deal with. In these circumstances, would probably result in some type of action against me.

A WARNING TO ANYONE WITH A CAPITAL ONE CREDIT CARD. I have had my credit card for just over a year now. I recently started receiving calls offering me "free gas", saying that I had been chosen for being a great customer of Capital One. After the first few calls, I did ask what this involved - the usual 'Free' trial services that you could cancel at any time. After refusing the services with the girl on the phone, and her supervisor, I asked to be taken off the list. About 8 weeks later, charges appeared on my statement for fraud protection (Oh, the irony), a discount club, and something else - arranging from $19.99 to $25.99. These were the same services I was offered for being a 'great customer' and no, I never gave them my credit card number. After the fraud situation was sorted (they refunded me the money very easily!!) I still received the phone calls. Just to be sure, I ordered a new card with a new number, but I still get the calls!

My husband was due to be working away for a while, to ensure we had enough money to tide my son and I over, he paid off my credit card. Three days later, when I needed gas, I checked my card balance - it said the payment had been processed, but there was no available credit on my card. I waited another day and still the same. When I phoned them - a long story short - it turns out that if you pay over half of your credit limit in one payment, they put a hold on your account for 6 days (due to possible fraud!! I would love to have my card fraudulently used if they are going to pay it off for me!!). Even after explaining my situation, they did nothing. They told me the money will be available next Tuesday (actually 8 days since we made payment).

My husband's hours were cut at work, so we went through debt consolidation and was told while in consolidation, I wouldn't receive any fees such as late fees or over the limit. That was a bunch of crap. So every time the consolidation group paid them the debt never went down, in fact it went up every month.

2 months later, my husband was laid off and I am on ssi. I filled out all the paperwork for my credit account care and so did my doctor and my husbands boss we sent it in and didn't hear anything for 2 months. When they started calling, I told them several times about the account care but they did nothing and said they never got anything. We sold what we could around the house and offered them 500 dollars to clear the debt and they said no, the minimum they could except is 736, but my limit was only 500 and the card was canceled to stop the debt from growing.

My phone was shut off because I couldn't afford that bill either, so I wasn't able to keep in contact with them. Then we moved. I received a letter a few months after moving regarding my account. In March 2008, I contacted Capital One to close my credit card account that had a not-so-ideal APR and a sub-par credit limit. I hadn't used the card in over six months and I had acquired better cards over the years. In May 2008, I was still receiving statements, with no balance, so I called again and was assured the account was closed. In early October, after around five months of no correspondence (I had even been locked out of the company website), I received a statement via email (and four days later via postal mail) indicating that I was carrying a balance as a result of the Capital One Member Fee.

On October 23, I contacted the Capital One Customer Service team and wasted an hour and a half of my life bouncing around to all corners of the globe. I hung up with the acknowledgment that my account was credited. During this ordeal, I was transferred to the payment protection team - at the advisement of a customer service representative - and canceled the payment protection on the account.

Today, I was greeted by another Capital One Statement. Needless to say, I was floored. Capital One was charging me a late fee as a result of a $0.38 payment protection that was administered when the previously credited $39 Member Fee hit the card. So, my wife took over, because I couldn't possibly find it in my heart to be pleasant or polite to anyone at Customer Service. Lets see, she talked to Vanessa in the Philippines, Frank, the belligerent supervisor from New Brunswick, Canada, Ross from Disputes in Bombay, India. Finally, we wrapped up with Tiara from Kansas in Payment Protection. The runaround started at around 5:45 PM and wrapped up just before 7:30 PM. We walked away with a guarantee from Ross in India that the account was credited and closed, but I'm not going to hold my breath.

During my early correspondence with Capital One, I expressed my displeasure with their follow through, and asked to be removed from all future mailings. While that request has never been honored, I believe based on the events from earlier this evening, I haven't had my last conversation with a customer service rep from Crapital One...

I'm writing on behalf of a family member who is absolutely destroyed now that Capital One Bank has taken over North Fork Bank. She is employed at a call center environment, with 60 plus calls waiting a day at minimum. With a service level of 30% when it's supposed to be around 80% or higher. The minute one call ends, another one follows, without one second in between. Its nonstop. They cancel morning breaks a majority of the time out of the week, if call volume is high. I feel Its very essential that they receive all breaks due to the high call volume. The managers don't allow you to have 2 seconds to yourself.

If there is a holiday or any given day where the calls are not as consistent, they're ready to send you home, using YOUR OWN voluntary unpaid time off. There's a thing called compliance which you are required to reach a certain month to date average which is 93% or higher, and is nearly impossible due to reps having to limit each call to less than two minutes and two seconds, while assisting clients.

Another issue is you're penalized for using the restroom which is over their allotted time frame. You have to suffer if you are on the phone assisting a client and the phone call runs over into your lunch time which, for example is twelve noon and let's say the call ends at twelve ten, naturally you're going to log off at twelve ten and return at twelve forty because you're entitled to a half hour lunch break. Unfortunately at Capital One Bank because you went to lunch late, you are considered late returning and it is deducted from your compliance.

If we were to hang up on the customer, it would be considered an auto fail, so they leave us no choice but to accept it. The person that I'm speaking of is a very good employee, and has been working with the bank for three plus years. As we stated earlier she's been employed with them ever since it has been North Fork Bank. She has never been written up or received any verbal warnings. She has kept a Great attendance and always meets the job requirements and expectations. I Come home every day and see this person mentally physically destroyed, this job is getting the best of her. It's indescribable the amount of stress and depression this person has endured working with this company. This is not just a problem with this individual 80% of her co-workers have complained and I've decided to take further action in hopes to seeing some results.

I accepted a $300.00 unsolicited credit card from Capital One back in 2003, and it's been a huge mistake ever since. The account was paid off and closed in 2004. Capital One has continued to haunt my credit reports by saying the balance owed is $1,918 and there was a charge off of $877. On my Equifax & Experian reports, it shows the account as being closed but Capital One still shows payments being received. On top of that, they show charge offs in between different months on the 81-Month Payment History, and they show the latest charge off being November 2008. How can they charge off something that was already CLOSED years ago?

In checking my credit reports, I also noticed that Capital One has checked my credit report on different dates and they are still trying to offer me credit. If I owe them so much money, then why are they trying to extend me more credit? This just doesn't make sense to me. Someone needs to stop this company in their tracks because they are consistently ruining people's lives. They keep putting in the negative reports so their account can keep riding on consumer's credit reports. They don't want their information to drop off your credit report in 7 years and it's just not fair. I don't recommend them to anyone no matter what good rates they cook up, because in the end, Capital One will bring you down. Now it's time for some watchdog group to bring them down!

Capital One noticed this and decided to raise my interest rate from 18% to 28%. GMAC corrected the error but Capital One refused to lower my interest rate back to where it was. The guy I spoke to at Capital One could barely speak English and was very annoying and unpleasant to say the least. I only owed about $400 on the card so I paid it off and told them to close the account. I know that Capital One didn't do anything illegal but it was unethical and it was even worse that after the error on my credit report was fixed, they still refused to lower my interest rate. When we refused and agreed to pay through our on-line bank service in a few days, they agreed. We did so with the expectation that we would receive a statement showing no late fee. They at that time refunded the fees and told me they would close the account and to cut up my card, which I did. Well, here we are again in the fall of 2008 and the same thing happens. I thought this account was closed, but they never closed the account, so it remained open and then again I was charged a service fee and another late fee for I had no idea this account was still active.

I phone 3-4 times on October 27, 2008. They said they would close the account and refund the fees in which they charged and said I would receive a confirmation letter in the mail within 7 days. This letter never came but a collection letter did. I called again on November 11, 2008 spoke to 3 people, not for sure what the first gal's name was, for hardly any speak English so you can understand. She transferred me to Daisy whose control # is **. She explained to me the account was closed and she would be sending me a letter. I demanded to speak to a manager on duty.

I was transferred and this lady tells me that my account is not closed and will not refund the fees. By this time I had enough - it was not about the money but the carelessness and complete stupidity on their part. This lady was going to then transfer me onto her supervisor, but as experienced countless times prior - I was completely 'hung up on'. So I paid the darn fees and have asked them again to close my account which still remains open today - I can't close this account, but they will continue to charge me fees every year on an account they will not close! A credit card was taken out in my name without my authorization or consent. I realized this once I ran my credit report. My husband and I called Capital One repeatedly without much luck. We called about 10 times and each time transferred to one person who transferred us to another person who transferred us to a department and then back to the original person we spoke with. Each call lasted close to two hours.

Through the fraud department, we finally discovered that a relative took this card out in my name, using my information. Due to this fact, there were only one of two options given to us. 1. File a police report against this relative. 2. Have this relative sign a statement of responsibility in which then the debt would be turned over in their name and out of my name, off my credit.

We chose option 2. We mailed this form, signed and filled out completely. We faxed this form to the fax number given to us and on the form itself. Every time we've called Capital One to verify the info was received, they claimed they never received it. We have since faxed and mailed many times and still no response and they still claim to not have received. It's been over a year and I'm still at the same point I was when I first discovered this problem. They treat me horribly every time I call, they treat me like the thief and not the victim. Even though it was a relative, it's still fraud and very much a big deal.

I was constantly faced with over the limit fees, late fees, an astronomical finance rate of more than 21% a monthly service fee (just to keep the card) and some more stuff. They would not accept or make payment arrangements... it was all or nothing.

So fast forward 8 years, Capital One is STILL pursuing this account... STILL charging daily interest on the account. So what was once a $100 credit limit is now a $5,000 debt. They (unknown to me) attached my bank account in 2005, and now in 2008, they are trying to go after my wages. With our caller ID, we decided to stop answering any toll free calls, since our experience told us it was Capital One.

Okay, so when I was 18, I got a card with Capital One. It had a $200 limit on it and being only 18 and thinking I was a hotshot because I was the first in my circle of friends to have a credit card, I was whipping it out everywhere, paying for things for all of us. I wound up $7 over the limit and of course incurred an overlimit fee. Okay, no problem, my fault. So, I paid the entire balance about a week after I got my statement, including the overlimit charge. Apparently, there was a 'delay' in the mail delivery and they didn't receive it until after the grace period, so they charged me a late fee on top of it.

I didn't find out about it, until I got my next statement and I called to argue my position. I told them that I had written and mailed the check with like 8 days left in the grace period, (at that time it was 15 days) and that there was no way that the mail could have been 'delayed' for the extra 8 or 9 days. The rep I was speaking with became very rude and threatening saying that if I didn't pay the late fee that it was going to ruin any chance I had of building a future and that I'd be a deadbeat that never got to go to college because they were going to wreck my first attempt at establishing credit.

Well, I got rude back at her and simply refused to pay the late charge and that they had better rectify the situation or else. She hung up on me. I kept getting statements in the mail and I ignored them because to me, this was a matter of principle and at 18, not realizing how badly this really could damage my future, I tried to stick to my guns. About a year later, I started receiving harassing phone calls, several times a day, starting as early as 6 am and as late as 9:30 or 10 pm. I ignored them until my mom told me that I needed to talk to them.

Finally, I answered the phone and they told me that I now had a balance of over $1200 because supposedly, I never paid off the initial balance that I had racked up and the remainder of the charges were incurred due to my 'negligence' in complying with my contract. I told them that I had proof that I paid off my balance, the check I wrote them had been cashed and they tried to tell me that at the time that I'd sent them the payment, it had gone toward a bunch of overlimit fees and late charges that had already been tacked on (for what reason, I'm not sure) and tried to tell me that I just didn't remember what I had done to deal with the situation because it happened a year ago.

Supposedly I didn't 'remember' that I still had a balance from bogus fees. So, they just kept on ticking more and more fees on top of bogus fees. After arguing with them over the phone several times, being transferred from one supervisor to another, my mom got on the phone and tried haggling with them for me. They told her that there was no way they would settle the account for less than half of what the balance now was, which would have been just over $600. She offered to pay them, on my behalf, $200, plus one late fee as a show of good faith, in case maybe I did actually 'forget' what my balance was.

They refused to accept her offer and told her to tell me, 'well, tell your daughter she's gonna have a real hard time in her life because she's so irresponsible with her credit'. Needless to say, my mom got ticked and hung up on them. Shortly thereafter, collections started calling me. I ignored them. Seven years later, just before the time was up that it would be expunged from my credit history, they sent me one last statement, offering to settle the account for somewhere around $2000, half of what it had grown to. Again, I ignored it, and FINALLY, it stopped haunting me. All this from a meager $200 limit and an ignorant kid who knew nothing about the kinds of scam artists Capital One actually are!

Every time I looked at my bill the interest rate kept increasing and late fees increased and it seems like no matter what I would pay the fees kept adding up. Also, they charged me a fee just to keep the card every month $6.00. They would want me to pay in full in order to keep fees from adding up to my balance. I could not pay in full; I only could pay the minimum or little more than the minimum. I just felt trapped like I would never be able to pay them off with all those fees, so I stop paying them.

"Oops," it says on the top, "you're behind by a payment"! Of course they never sent the first statement and when I called and pointed out there wasn't even time in there to have been billed a first statement I was put on hold forever, Then transferred to a different manager, and when I inquired when they sent the first statement and she replied, I pointed out it was the day before the balance was transferred. And there was only two weeks between that date and the date of the statement I was holding - so how could a statement have been sent in that amount of time?

This is obviously fraudulent manipulation of the situation on their part to charge me a whopping $87.00 in finance and late fees right off the bat, and instantly eliminate the no interest bait for the card by claiming I had missed a payment. They said it would be ten days and I would receive a letter, and I'm waiting to see if they reinstate my no interest card I signed on for. Have had four Capital One Cards which I used on a rotating basis (pay one off, use a second). Came into a windfall and paid all cards to zero. Credit rating is in the 800s. Sent an e-mail requesting the four cards be consolidated into one. Received an immediate no-reply message telling me to call the 800 number which is answered in India. The first attempt was met with me talking to an undiscernible correspondent who cut me off after 30 seconds. The second try was met with the recording of an Indian gentleman who said all communications with India were temporarily disconnected. Next, attempted to communicate with the company via snail mail. Gave them three months to complete this consolidation. They missed the deadline. Heard nothing from Capital One. So I cancelled four cards. A final call to Capital One and I actually reached a man who sounded like a U.S. Citizen (or Canadian). He instructed me to call another 800 number. That 800 number to India was temporarily disconnected. Presently, all four accounts show up on the Capital One Website with an asterisk telling me to call that familiar 800 number.

Asked them to review my spending habits but no response other than I will be liable until I prove to them different. I had four credit cards, all with a limit of $1,000 or less. I paid off all of my cards and notified the company, then moved out of state. I had a forwarding order with the postal service. I recently moved back and found bills for an annual membership fee and late charges that totaled over $500. I called the company and they said they had no record of me closing my accounts. They hit me four times for annual membership fees, plus late charges. There had been no activity on the accounts since I closed them.

I mailed written correspondence. I called their customer service three times. I was hung up on by one representative. Finally, I asked to speak to a supervisor. They agreed to make all the accounts $0. If I hadn't been so persistent and demanded they remove the charges, I would have had to pay the fees and had late charges reported on my credit report.

I called Capitol 1 earlier this month and gave them the names of 2 banks (credit cards) with their addresses. One was Juniper and the other Bank Of America. Capitol 1 mailed a check to Juniper for $5,150.00. This was done correctly and my Capitol 1 account has properly applied for this amount. Capitol 1 also mailed the second check in the amount of $6,207.00 to Juniper. They did this in error as this check should have been mailed to Bank Of America. When Capitol 1 mailed the $6,207.00 check it was made payable to Bank Of America with the correct Bank Of America account number on it. So how Juniper was able to cash it I do not know. I was able to get a representative from Capitol 1 and Juniper together on a conference call.

Thursday morning 10/23. The Capitol 1 representative, Sherise, gave the Juniper representative, Dana **, the account and routing numbers of the $6,207.00 check that Capitol 1 admits to sending to Juniper in error. Juniper, as far as I know, has not been able to locate this check. I called Capitol 1 to advised them that if Juniper has not been able to locate the check and send it to Bank Of America by the time the minimum payment is due which is 11/2, Capitol 1 will have to reimburse me for the minimum payment as I have to protect my credit rating. The Capitol 1 representative had nothing but attitude. She acted as if I was bothering her. She said that maybe they will consider reimbursing me. I advised her this is a reasonable request since all of this is Capitol 1's error but she was totally disinterested.

I asked to speak to someone higher than her due to her poor attitude but she advise me that there was no one else to speak to. She said I could call back to speak to someone else. I said what would that do since there is supposedly no one higher than her. She continued to be very sarcastic. I again asked to speak to someone higher than her. She kept refusing and even when I told her not to hang up on me and she still did.

I have had a Capital One card for several years. My credit line started at $300.00 which I paid on time every month. I needed an increase, so Capital One increased my credit limit to 700. Again, I made my payments on time every month. My husband lost his job and we found it more and more difficult to make the payments. I called Capital one many times and tried to explain that we could not make the min payment and could we work out a workable solution. I was told Capital one does not do this. I told them if we couldn't work out something -it would end up going to a collection agency - in which it did. I wrote back the collection agency and told them my situation and asked again for a workable solution - again nothing.

I was getting medicine for my daughter and used my debt card to find out it was declined. I called my bank to find out why it was declined and found out that the attorney that is representing Capital One had frozen all of my accounts. I was NEVER served with court papers and now stuck without any money to buy food, gas or medicine for my daughter. I called the attorney and he said basically tough luck. They froze everything with my name attached to it - which meant my daughter's bank account. I told him the money he saw in my savings was for the mortgage. If we are behind one more month we will lose our house - he again said that's not his problem. As far as I'm concerned Capital One and the law office they use are crooks. I had to pay 1,700 + for a 700 credit limit. IF ANYONE READS THIS - NEVER NEVER USE CAPITAL ONE BECAUSE YOU NEVER KNOW WHAT THE FUTURE WILL HOLD.

Capital One Credit Cards billings are manipulated and charged over the limit fees when accounts are not over the limit. The over the limit charge does however take you over the limit and hence another over the limit fee is then charged. This has been happening the past couple of months since I called asking that my interest rate be reduced. I was told it would be if I had no over the limit fees. I have watched my statement carefully online and just checked the statement a couple of days ago and still had a small available balance. My credit limit is $5,000. My balance now is $5,021.76. It went over the $5,000 limit when the $39.00 over the limit fee was charged on 10-25-08. It doesn't take rocket science to look at the balance and when the only recent charge was the $39.00 to see that my balance couldn't have been over the limit when my account was assessed the $39.00 fee.

IF YOUR TIME IS IMPORTANT TO YOU, NEVER USE CAPITAL ONE CREDIT CARD. They are the worst in the industry! For the 4th or 5th time in a few months, they have put a hold on my credit card for no reason. It is so embarrassing! I am waiting in line to pay the cashier at a supermarket and the card gets declined. I know that there is plenty of money on the card, so I called the customer service number. Guess what? I am transferred to India, where I could barely understand the customer rep's thick Indian accent. I had to repeat my card number several times, then she argues that the number I gave is not a legitimate number. I said, "What?! I am reading the card that you, guys issued me and I have been using this same card for years." Then, she puts me on hold for several minutes. Upon her return, I remind her that I am still holding up the line at the supermarket and people are starting to glare at me like it's my fault that my credit card is having problems.

The service rep asks me to repeat the credit card number 2 more times, puts me on hold for 3 more minutes and then says that there is no hold on the card and for the cashier to try to run it again. For the 4th time, the store cashier runs the card and again, the computer screen says that the card is declined. I tell the service rep this, and she still insists that it is not on their end, but on the store's end. The cashier runs the card 2 more times. Same thing. I ask the service rep to be transferred to a supervisor and she says in an-I-don't-give-a-crap voice, "I can't transfer you until I exhaust all the troubleshooting possibilities. What are the last 3 digits on the back of your card?" I give her the number and she says, "That is an invalid code." Again, I shriek, "What?! I am simply reading the back of my card and I have used this code and this card for years? What is going on?" She says (amused), "Hold the line"... Again, I was on hold for several minutes, then she comes back on the line and said, "I don't see any problem on the card. Run the card again"... Maybe this time it will work. I ask the cashier (who at this time, is now glaring at ME), to run the card one last time. Guess what? Card is still declined and the phone goes dead! Unbelievable!

    2) Does Capital One have an obligation to notify me of an overdue balance? If I did in fact enroll in paperless billing, is it unreasonable to expect notification of an overdue balance (whether by email or standard mail)?

I have been trying to keep paying and at least doing the minimum payment, even though sometimes it is hard, and recently I had a big bill due from not staying on top of my bill, but when I paid on one of the cards, and then gave them permission to pay for the other half on my other credit card, they thought they could take a second payment out because I authorized them to do the other ones. And because of them doing this, they took out an unauthorized payment and it overdrew my bank account. Which then also gave me a late fee on my bank account, so I called Capital One, and told them they didn't have the right to do that and not only did they need to put my money back into the account, but they needed to pay my overdraft fee also.

I explained to him that in this day and age if you do not have at least one credit card, you might as well kiss your credit rating goodbye. Which he recently found out. He owes no one, never has, but now he cannot get any credit because he has no credit. It doesn't matter that he has always paid all his utility bill on time, or that he is not in any debt. But cause of his bonehead attitude about credit cards, it now is hurting him. I called Capital One several times. Credit counselors tell you to do that. They say the worst thing you can do is to ignore a debt. They would not work with me at all. They were rude and just read me my bill over and over. I was asking that they give me a 2-3 month reprieve so I could catch up on payments. They were not willing to stop adding interest for a month or two, which or course caused me to go over my limit, so I was then charged a late fee and an over the limit fee. They were not willing to reverse any of the charges. Eventually I just stopped paying them.

My account went into collection. The phone calls started, from 8am until 9pm including Sundays. I stopped answering my phone. Eventually they took me to court & put a lien on my property. Since they ruined my credit reports already, I filed a Chapter 7 bankruptcy. This was my only debt, since I am not willing to pay them a huge amount of interest and fees. Either way my credit is ruined but I feel, due to their shady practices, I will recover faster from a bankruptcy. I would willingly join a class action suit against them. Upon checking my checking account balance, I realized that my checking account had been wiped clean and my account was overdrawn. In shock, I spoke with one of the representatives at my bank and was told that Capital One had garnished my account. I was flabbergasted and confused to say the least. About 3 1/2 years ago, my husband had an account with Capital One that was turned over to an attorney. Shortly after we received the notice from the attorney, we signed up with a credit counseling agency. The attorney's office that had taken over the Capital One account agreed to let us make payments through the credit counseling agency.

For 3 1/2 years we have been paying $306 a month on that account, never missing a payment and always paying on time (the money comes directly out of our account on a specific day each month). In the 3 1/2 years since we began paying the agreed upon sum, we have had no further correspondence from either Capital One OR the attorney (we were following our end of the bargain - they had no reason to call us!). Upon discovering that Capital One had garnished our account - wiped it clean, no less! - we first contacted our credit counseling agency who informed us that we are indeed current on our payments and, in fact, only have a remaining balance of around $600 on our account!

We have never had a judgement entered against us for Capital One (as far as I know) and have never received any notification that our checking account was going to be garnished by Capital One (as I mentioned before, we haven't heard anything from them in the 3 1/2 years since we made the payment agreement!). I'm not sure exactly what has happened here (it's the weekend, so we aren't able to contact any of the people we need to speak with), but it seems that Capital One has fraudulently taken money out of our account. And, we don't know if they're done!! It seems they've already taken double the amount that they are still owed out, and the bank says there is nothing we can to stop them.

I'm absolutely sick because we have been diligently paying them monthly for 3 1/2 years and all of a sudden they have dipped their hands into our checking account, leaving us with NO money for food, gas, bills, rent...Also, my husband and I both have direct deposit, so we are not sure if both of checks will be taken out when we get paid next weekend. I don't know what Capital One is up to, but it is NOT RIGHT!!

I opened an account with Capital One the beginning of August 2008 and requested two balance transfers. One with a credit card company and one for a loan attached to my checking account. At no time during my application process nor the other 3 times that I called looking to see why the loan has yet to be paid off did anyone tell me that they cannot pay off a loan that only has 9 digits nor one that isn't with a credit card company. I was told by a customer service agent that I would have to wait until Aug. 30th to give the check time to get to the bank before I can do anything about not receiving it. This check was processed on Aug. 14th.

I call on Aug. 30th and by this time I was told that they cannot help me after over an hour on the phone, the account has to be 16 digits so I ask for a check to be mailed to my home and I was told by two different agents that this was not possible. I then requested to speak to a manager in which he told me that it IS possible to send me a no hassle free check but the system is down and that I should call back after Labor Day and request one. I did that exact thing and spoke to another customer service rep and after being on the phone for over a half hour, she promised I would have the check no later than Sept. 19th. As you can guess, I still do not have the check.

I called today and I was told by yet another customer service rep that the check was never issued. I requested to speak to a manager. Once I explained my situation to her she begins to tell me that the check was failed to be processed and she will issue another one and it will take 5 days to process and 10 days to mail. My issue is this, why do I have to pay for your employees' errors? I have been promised for over a month and a half this check and yet I have no check. This mgr claims that she is the only manager that I can speak to in that building and that there is no one higher than her which I highly doubt unless I am transferred to another dept. She said she can transfer me to another dept. and when I asked what good that would do me she couldn't give me an answer.

I know there is alternate ways of shipping seeing as I work in Human Resources and deal w/ payroll for the no. 1 distribution company in the USA and I also know that when a company makes countless errors you do whatever is possible to make your customer happy. I asked that a check be overnighted to me in which I was told that is not possible, I told her I will work w/ her and would wait til Monday and she still told me that is not possible. She said that I would have to wait the typical time line for any customer requests even when I have waited extremely too long as it is. She in no way tried to help me and I find that very disheartening especially in the times we are in now economically.

I have an 800 credit rating which means I can do business w/ just about anyone and I chose Capital One in which I highly regret now. I then requested another check for the third time and was promised but this agent that he would personally make sure it goes through. Of course, it didn't and I had to call and speak to another 3 individuals before I got Jamie a senior manager. She told me I could go to a bank and get a cash advance and she would personally change my account from a cash advance to a balance transfer. I went to use my card last week and it was declined. I just found out someone closed my account and it was not me.

I called today and asked them to pull up the recording of me allegedly canceling my account and after being transferred to 3 different managers I was told that there is nothing that they can do for me and that they cannot pull up recordings. I never in my life have dealt w/ such an incompetent company and never in my life will I ever do business w/ them again.

My Application was approved in July 08 and my Secured draft of $300.00 (Money Order) was sent out to Capital One in August 08. Today, they have received the request and they will send out my Credit card a.s.a.p. after completing the verification, a total of five months. Initially, on phone, the information I gave them was clearly explained regarding my mailing address which is at PO Box but the lady representative did not pay any attention to my instruction not to send it to my Home address which is at **... and so on. So, she mailed out the Credit Card to my home address instead of the PO Box no. and I never received any credit card from them since then.

I was so worried that something went wrong. So I called up the Capital One again to find out, the next thing I remember was the lady told me that they have sent in the credit card to my Home address which is at **... I told her that it will be returned to the sender if you have sent it already. The lady operator just explained that the department have sent it already, but she will change and update the mailing address a.s.a.p. and will resend it once again. When finally after 2 months, they have received my first returned credit card because of an error that was made in the first place sent to the wrong mailing address.

So, they wrote a letter again to me saying that because of government regulation... blah, blah, blah. I must send them a copy of ID photos with my signature plus 2 copies of my bills etc. So, they can resend out my Credit Card in the mail, a.s.a.p. Today, I just got an information that they have received my information that they require. So I have to wait for another 7 to 10 working days to received my Credit Card. If I get this Credit card within the next 10 days, a total of nearly 5 months was wasted since my $300.00 draft monies was sent out to their collection department last July 2008.

Earlier on today around 11 a.m., I have just spoken to Mr. John ** - at tel.1800-4813239 and I told him I am so pissed off about the delaying tactics that your Co. is doing. When I asked him to verify my information, he cannot find my file based on my name, Phone no. and Social Insurance No. So, I asked him what if I just cancel the whole thing and refund my $300.00. He said that the cancellation will take a minimum of 60 days to get your secured money back in the mail. He suggested I might as well just keep the credit card instead of canceling, it is not worth it.

I had gone into the branch on 9/22/08 and requested to have an account closed and a new account opened. I withdrew my money and placed $173.00 in the new account. One week later, I come to find out that the account was never closed properly. So in the meantime, I am being charged NSF charges of $35.00 apiece and the account ended up being $539.00 negative. I approached the bank location and they said it is not their responsibility to make sure the account is closed. While this is happening, I have 2 other accounts there that they froze all my funds.

Being a small business owner, I can't be without my funds. After going into the branch and sitting down with them and having a meeting, requesting that they make sure to close that account properly and refund us for the NSF charges that were charged to me. The following day, Will called me stating that he had spoken the the branch manager, Michelle, and they had decided to close all of our accounts. I spoke to Will on Monday and he stated that all of my funds would be released Wednesday 10-15. I went into the branch today to retrieve the balance of my funds and now they say that I can get them tomorrow. I need these funds to now open a new account at a different bank so that I can run my business. They have not been ethical about any of this. They also are stating that they will NOT be refunding the NSF charges that was their fault for the account not being closed properly.

They call relentlessly from morning to night, weekends and holidays, even though I have asked them each time not to call again. Nothing is sacred to these people. I have spoken with supervisors there only to be told it will take a few months to update their database and get my contact information out of their systems, even though I am on the National Do Not Call List. The worst part of these calls is not only the inconvenience of being woken up in the morning or at night by these people or during dinner, but the fact that when I ask them not to call back they get rude and disrespectful and hang up the phone in my face! Only to put me through the same exact thing the very next day 7 days a week! It's like a recurring nightmare. Something needs to be done. I shouldn't have to go through this kind of treatment in my own home for the next few months until they update their database. This is just ridiculous.

Let me be very clear and unambiguous, we do not want a Capital One Credit Card. We do not want any balance transfers and we request that you immediately destroy all the information we submitted. Please be advised that we called for a balance transfer. We were told we were approved up to $30,000.00. We were advised that they were unable to process the request unless we gave them balance transfer information. The person we talked to was Brian who clearly did not know what the process was to cancel. When we found out that there only was an approval for $2,000.00 we indicated that we wanted to immediately cancel and we were told that was not possible. Brian indicated that we would have to call another number to make the cancellation. We made a three way call and Brian was present for the entire call with the cancellation department.

We called and talked to the cancellation department which was located in Texas. At that time we talked to a person who said he could not accomplish the cancellation but gave us his supervisor who was Mike whose employee I.D. is **. When after 15 minutes with Mike checking he advised that he would be unable to cancel and we would receive notification in 7 to 10 days. I said that was not acceptable. I asked to talk to his supervisor and was advised that he could not give that information and his supervisor would not talk to anyone. The fact that they said they could not cancel was based on Capital One policy. I requested to be advised exactly what the Capital One Policy he was relying upon and was told that he could not provide that information.

I asked multiple times why they could not cancel the application and he said it was not possible. I asked why and never received an answer. I also asked to obtain a fax setting forth in writing what they had represented. I was told that they did not have a fax machine in their office. I was told that to cancel I would need to write or fax your office. I am doing this and want to receive an immediate fax confirming the cancellation and assuring us that no balance transfers will be accomplished.

When I explained to her there was no one here by that name....She proceeded to become rude, sarcastic, and demeaning, yelling at me that I should have called (long distance) and told her she had the wrong number. It was the same woman who called me each time.

After she proceeded to read me the riot act....she then hung up on me. Yes she did! But not before sarcastically telling me to have a nice day! I never got her name, she had an accent and was hard to understand. I immediately called back and asked to talk with someone for customer complaint. That's when I got this Mr. ** who's attitude was not much better. He put me on hold twice, and when he came back finally he very curtly said my number was removed and I should not receive any more calls. His comment to that was: "well as I said, your number was removed from our call list." He never apologized for the woman's rudeness or hanging up on me. I told him his attitude was not much better than hers. I am not a Capitol One customer, and after this, I would not even think of asking for an account with you. For some reason this month, they told me my payment needed to get put on hold for 10 days... One, I'm late I have received a late fee of $39 and not to mention a Over the Limit charge ($39) to go with it, because their past due charge made me go over the limit. Now, they say they can't do anything about the charges, because I made my payment too early that billing cycle didn't end yet, I was supposed to wait till Sept. 2nd to pay then it would have been applied to that statement instead my payment on August 23rd went towards my previous bill which end on August 2nd that payment had already been made and posted.

BAD COMPANY BAD SERVICE!!!!! RIDICULOUS FEES!! Early payment how crazy I have to pay fees (Late & Over the Limit) for an early payment! They simply say we're sorry, I am sorry you feel that way. We can't do anything about it, it is system generated. I see enough complaints on here, I don't understand why they haven't had a CLASS ACTION put against them yet. I have had the no bill statement happen to me by this company to when I first enrolled, they had charge me late fees, but fortunately they credited it back maybe it was only because I hadn't gone into debt with them yet. I received a $3,000 credit limit and was making my payments on time every month for about 5 months and they told me that I was going to receive a $500 credit limit increase if I kept making my payments on time. They sent me balance transfer checks and more information and increased my credit limit after 6 months. I went to the store one day and was going to use my card. (I knew that I had like 800.00 dollars available with the increase I had just received and I didn't have my debit card on me so I figured no big deal considering I only bought like $11.00 worth of stuff). The lady at the store ran my card and told me it was declined. Impossible I thought.

Well I went home and called immediately thinking that someone had made an error or stole my identity or something. Nope. Apparently they had made a mistake when they issued my credit limit, and the credit limit increases. They had decreased my credit limit with no prior notice. They decreased it to $2500 leaving me over my new credit limit. Then they start charging me over the limit fees, and late fees for not paying the complete new minimum of the 300.00 dollars.

I had not missed or been late on a payment on this account or any other account. It took me 6 months to get it under the new balance and no one wanted to help and told me they sent me a letter telling me they were going to decrease my credit limit. When I asked for a copy of the letter they told me they couldn't find a copy of it right at the moment but that I had received it. I also asked if they would reverse the fees or give my acct a review and increase my limit so that it wouldn't put me over the limit and they said no. They also stated to me that they had others they had made mistakes on and they were also reporting that they had not received any letter either.

I don't understand how you can be sending out balance transfer checks to use on your acct. that you are getting a credit limit increase on and they be told you knew they were decreasing you credit limit. I think that there has to be some sort of law that was broken by charging me and not sending me the letter when I asked for a copy of it. I was so embarrassed when I was told my card was declined in front of like 6 different customers, I had no way of purchasing the dinner items I needed. I ended up paying way too much in fees and I am still getting over the limit fees because I am now very close to my limit every month because of the interest. I can't pay the card down because of all the charges I just want to get rid of this card.

So we ended up getting results in the mail of creditors that in fact had closed out our accounts. Every one sent out info on our accounts being closed, for the exeption of CAPITOL ONE. They cashed in the checks sent to them. And never closed the accounts out.

In their statements, terms and conditions it states the account has to be paid to 0 before the account is closed out. So in what efforts did they use the pay-off money sent to them to close these accounts out. They basically took the money then purposely did not close these accounts, even after notifying them over the phone. And now recently went into our bank account to try to recieve funds owed to them, which in fact they were already paid in full by a Bank. And are sueing me for compiled interest rates.

When I received my bill, I had two charges, one for 5706 and another for 102. Without an receipt or anything I had signed, I could not understand the fees as they were different than I was told. I went through the dispute department of the company and was finally told that there was nothing they could do, they must honor what the credit card had told them was the charge. I then went to the Better Business Bureau.

The only response they have made was to forward a letter dated 7/23/08 from BMIT telling that they had finally attached a receipt to the BBB. They had not. The Boston BBB had sent me the letter and I had to ask repeatedly for the receipt. The Boston BBB finally said they had no receipt. Just last week (almost 5 months later) BMIT forward a short receipt to me. My concern is that a credit card company does not require any substantiation of charges and goes purely by the company's word.

In addition, the company churned the dispute. I would be told to send them paperwork to explain my charge. I would check, they would have info. Later they would close the claim, saying they had received nothing. I had to begin to send all info through the mail with delivery notification. I was often told they had something, told a little later, they had nothing. Once this situation is straightened out, I will close this credit card. However, I would like to believe that credit cards require something proving a charge. Something with my signature or a receipt upon request.

I applied for this card after i had a stroke in 2005 and was on full disability benefit , i am still off work on long term sick and do not need crank calls 24/7 even sunday mornings when in church. The card was a 200pound limit and i am being charged intrest at around 30 pound a month, i know i owe the money but it seems to me a drastic tactic to try and recover this debt..i am no longer on full D.L.A. and get 83 pounds a week in benefit now.

    Thanks for your vote!
