I received an offer for 12 months at 0.00% with a 3% transfer fee, and borrowed $5,600.00. Capitol One is charging me a finance fee on part of it, and my balance is right at that amount, with last month's payment of $1,810.00. I will fax or send statements if needed. I think it is a fraudulent charge. They are charging me with a finance fee of $35.37, which I don't deserve, because I paid my $112.00 transfer last month.

I used to have a Capital One Credit Card which I have since closed and am making what payments I can make on a monthly basis. I don't make much on a monthly basis so I pay what I can afford on all of my bills making rent, utilities and food, a priority. I don't go out to eat or buy clothes unless I absolutely need them.
I have cut all of my expenses drastically so I can make more than my minimum payments on all of my bills. Capital One has contacted me via telephone and letters saying that I am delinquent and if I didn't settle or make huge payments, they would take me to court. With a small salary, I can only pay what I can afford. Like the old saying goes, you can't squeeze blood from a turnip.
I work hard for my money and have made payments every month to pay of the remaining balances but with the enormous interest rates that they have added and penalties have not put any dent in the bill. Now, I am being sued by Capital One and every other day a process server is knocking on my door trying to serve me papers for a court appearance. I am afraid that if I answer the door to this process server that I will be forced to go to court and the courts will decide in favor of Capital One and I lose everything that I have worked so hard for. Most of what I have, I have bought at Thrift Stores and Salvation Army because I can't afford full retail prices. The majority of my clothes have come from the same stores. I am also afraid that if they continue they may show up at my place of work to serve me papers and that would totally embarrass me and could end up in me losing my job.

We have a home equity loan with Capital One. We've had this for a little over 3 yrs and before this, the loan was a mortgage that was paid in full within 5 yrs. When we took out the equity loan, the girl put our due date down so with our grace period of 10 days, our every other week paycheck would make it possible to pay our payment on time each month. Since 2006, we've had one late payment and that was paid immediately, which that was my fault on the lateness being of one day past the grace period.
For some reason, Capital One has started phoning me at work, today, thrice and one phone call was the supervisor after I asked too many questions that weren't answered. I asked for their supervisor. We have never been called before. Not even last month when the payment fell on the same day because the pay periods were on the same days as last month. After speaking with the supervisor, I sent a fax to have them stop phoning my work and it was sent to the phone number the supervisor gave me.
After I sent this and had scheduled a payment for the 19th via my checking account with Capital One bank, I got another call from another twit. These people absolutely lie and continue to harass me when the payment is being made within my 10 days grace period. No late payment is even due. Can someone tell me how to take care of this problem with them? I’m short of just hanging up on them with each call. If I was late, it would be one thing, but I'm within my grace period per the contract with Capital One. I will lose my job if this harassment doesn't stop. The calls take me away from my job and my supervisors think because of the 3 calls today and 2 yesterday that I am not paying my bills.

The Capital One card was in my husband's name for use with his business. I was listed as someone who could sign, but not a joint account. My husband's business filed for chapter 7 this past November; since then we have not heard a word from anyone. I had recently run my credit and found that Capital One was on there so I filed a dispute.
Now they are calling me with the threat of a lawsuit. They will not or can not provide any documentation that I was on the account or how the account was set up, just that they want paid by me now. We have always kept our stuff individualized due to his business; he is not on mine and I'm not on his. Funny that they had no contact or complaint until I tried to get it off my credit report. It has ruined my credit report and could cost me my job.

Capital One Credit Card Company is very fraudulent. I was charged a 39 annual fee this year which I have never been charged since I received the card. I have a $6,500.00 card limit and paid it off except for the fee. Then when I received my online statement, there was 41.17 due. Explanation was there was 2.17 charged for interest on the balance for 3 days or whatever. I really don't understand but was told I had to pay fee and interest and they would figure how much more interest I would have to pay to have a 0 balance. Hopefully the amount they gave was right and that my account will actually have a 0 balance. When is someone going to put a stop to all this nonsense with Capital One?

I sent out 3 of my credit cards with wrong stamps. I received them back, 2 weeks later. Well, that made them late. The other two said. "No problem. You have always made your payments on time," and they waived their fees. But not Capital One.
They argued with me and said they would not remove all their fees. They took a $500.00 credit limit and turned it into $1,130.00. I asked them to stop their fees, and they refused. They have destroyed my credit. At one time, they agreed to take a $500.00 settlement, but I asked for it in writing, and they would not send a letter.
Now, they have sold it to someone from another company. And I am not getting anywhere with these people either. Can you help please? They have destroyed my credit over a stamp.

Capital One had contacted the IRS saying I owed them around $1,300. They said that sent me some 1099 to calm on my taxes. I had to tell them I never received them and I never had a credit card with this company. I have problems in the past with my son using my name in credit cards before. I had contacted the BBB with this and they closed the case. I want something done with this company, They will not listen to me. They are saying I did have these cards. They will not do anything about it. I'm to the point I'm stressed out about this. I'm not eating this money. I never had their cards.

My card has been charged off since 2006 and it has damaged my credit rating. I was making more than the amount of payments and they kept hiking up my charges. I was also making payments over the phone. Their agency has been calling me for the past two days and harassing me. They are calling every five minutes, and being very rude to me. I am fed up. I do not feel I owe them any money because they have already damaged my credit. They will not change the status of my credit or send me a statement or work with me, so why should I work with them.

Well, I left Alabama on active duty orders and someone who lied to me to gain my trust, used my credit card without my knowledge and racked up a big debt on my Capital One card. So, I filed a fraud report with them and nothing was done. I told them I have police report and orders showing I was not in the state of Alabama when this happened. Instead I keep getting transferred from one representative to another saying they can't help me with my account.
When I do get transferred the last time, it went to someone's voicemail, which I left a message and no one returned my call. My card has a $1000 limit and this person manage to over the limit by over another $1000. Explain how they let that happen. I reported this last June and til now the problem is not resolved. Now the bill is in collections. I will pay the debt that is mine no more than $800. The bill is now $2700. I cannot think to even afford to pay that as a single mother.

They issued a promotional interest rate of 7.35% with no stated deadline. All my payments were on time and I have a credit score of 767 as of February 2010. Capital One issued no direct warning of credit card increases in my prior bill on February 18, 2010 stating in small print in the middle of the second paragraph on bill rate changes information with multiple dates.
Nothing was legible in pointing out the outrageous change in interest rates from 7.35% to 17.9%. Capital One should have made this more obvious. I felt scammed and will cancel Capital One Card immediately. Please warn other consumers. I needed to re-arrange finances to avoid paying this loan shark interest rate and cut back on an already bare boned family budget. I will complain to the state.

I signed up and was approved for a Capital One Credit Card in I believe it was the late fall of 2006 or else Beginning of 2007. I was unemployed but got an offer to sign up for a capital one Credit Card, so I did. When I went to activate the card (Note it had a $500.00 credit limit), they asked me if I wish to add a protection plan to my card. It would cover my minimum payments in case of illness or loss of job. Well, in June of 2008, I ended up going through a surgery that nearly killed me, and was out and unable to work from June of 2008 until July of 2009. Since the state was giving me $230.00 cash assistance every month and I had medicines to pay for, I made my monthly payments, and have to admit that I had to use the card towards medicines but continued to make my monthly payments.
My cash assistance ended in June 2009, so from July to November, I made my payments except for one month I missed, which after fees and protection plan fees, put me over my limit which in the end, I had to come up with almost $130.00 in order to go back under the over limit area. I had contacted Capital One during July until November two times through the email site, telling them I needed to make a claim against my protection plan and I needed the information on how to do this. All I got was an email back saying to contact customer service. When I did this, I got a customer service representative which I couldn't understand due to their accent.
So I asked her if she could send me the information I was requesting. She said she would but I never got anything. I eventually ended up writing a letter to Capital One only to get no reply. I tried to email again only to get to call their customer service. I told them per my letter, since their representatives have such an strong accent, I have too much trouble understanding what they are saying, so I wished all contact and information to me sent to me via snail mail. No response. Finally, I made a final payment in November 2009. Sent another letter, telling them I was busted. I could no longer make a payment and needed to make claim towards my protection plan. This was the beginning of December 2009. No reply.
Since then, I have not paid them anything and now, I get phone calls up to 4 times daily from them. I told them on the phone many times that I couldn't understand what they were saying and I told them what I needed. They tell me that they go through a different company for that and they don't have that information to give me. I asked what was I to do without knowing who or the number I was suppose to call and they told me thank you for calling Capital One and hung up. Now, since about February 20th 2009, Capital One called up my cell company Verizon, who gave them all cell numbers that are under my cell account. The second number on my account is not mine and above all the person it does belong to is under contract with my cell company. But since he started out under mine, they gave Capital One that number.
When they contacted my friend, he told them that this cell number wasn't mine and did not belong to me and to take his number off their list of phone numbers to call. After one week, they called again 3 more times to his cell. Eventually in March I, called them told them that the number they were calling wasn't mine and that it was to be removed. (this was the second request for removal). She asked me what the number was and said it would take up to three days but it would be removed.
Then she asked me if I was able to pay my over limit charges, when I told her no and that I have been trying to get the information to make claim to my protection plan, she told me that I need to call another company and the information was on my statement. What? I said no one told me this and I did look thru my statements before, I did not see anything about calling this number. If you need information or make a claim from your protection plan. Anyway, I looked and saw no such information.
Then she said that the number would be removed but it would take three days. Four days later, on March 14, 2010 (today), he got calls from Capital One yet again. He called them back, told them this was it. He had enough and that he requested his number be removed and this would be the 4th time in 4 weeks he has asked and that this time he was going to turn this over to an attorney for harassment. The women on the phone said to give her the number and that she would process for it to be removed. He said no, I am sick of this. You guys told me this three times before in 4 weeks. Enough is enough. He asked her for her name, she refused to give it. She said her name had nothing to do with this and she told him thank you for calling Capital One and hung up.
I don't get why they couldn't give me what I asked for from the very beginning. I don't know why they don't have customer reps who speak English without an Indian accent, so strong you can't understand them. I don't understand why after I told them repeatedly that until they gave me what I asked for that I was no longer going to deal with them, yet they continued to call me 3 for 4 times daily since December 2009. Right now, I am almost $300.00 over my limit with over charge fees, protection plan fees etc. I can't pay it. I never was employed.
When I signed up for the protection plan, I was never told I was not going to get it if I wasn't employed. I was never told that the protection plan won't cover if I was sick prior. In fact, I never got any information about the protection plan at all after I accepted it when I activated my card. Now, they still won't give me the information and as I see from your site, it would do me no good. So I have been paying for something from the very beginning I didn't qualify for since about 2006.
My fiance' keeps getting repeated calls on his cell, which is his is his work phone, where he gets his business calls. They harass him almost daily even though we told them that the number wasn't mine. We have requested the cell number be removed from the account 3 times and he is getting so upset by it that now he lets all his cell calls go right to voice mail. From this, he has missed out on a few jobs. As for my backlash, numerous voice mails daily, was sold something which I find out now, I can't use. Not being informed now puts my credit rating in the gutter big time.
And now, I have a forever racking up credit card bill with Capital One on late fees. Not telling me this from the beginning really puts a hurt on my situation now because I have no means to pay them. I wasn't in such a stressed state, until I find this out. What in god's name am i to do now? They are making my life a living hell just by the phone calls, knowing fully well I told them I couldn't pay them and that I needed to make a claim to a plan that now, I cant use anyway because they would tell me I don't qualify because I wasn't employed.

Capital One sent me letter stating that they would be raising my interest rate but that I could cancel the card and only be charged my current interest rate on the remaining balance. They weren't true to their word. They charged me the higher interest for over a year. When I paid the card off, a month later I received a bill for Interest on cash and regular purchases. I have never withdrawn cash from this card and have made no purchases in over two years. They charged me additional interest once the card was paid off. This company is very shady and I wouldn't recommend it to anyone. I called the company and was put on hold for 16 minutes. When someone finally got on they said that there system was down and they can't help me. I would need to call back on another day.

I have my paychecks direct deposited into this account (Capital One Prepaid Mastercard) as I am a domestic violence survivor and need to keep my identity and location safe. Anyway, last week, it took them four days to release my pay and today, I called and they show no record of my direct deposit, yet payroll company states they do have it. I am unable to pay bills that are due because they have a excuse after excuse on why my money hasn't posted to my account. I'm told the are manual posting all of their direct deposits that all they know, it will be 10 am, then 5 pm then 11 pm then four days later. I don't understand!

Capital One sent letter 2/09 saying that interest rate would change to 18% or I could close account and if unpaid balance, keep at 7.9%. Therefore, I closed the account. Just finished a 30 min. letter to our bank underwriter (for construction loan) to explain this negative impact on my credit score, even though it's the only neg. New bank regulations are tight and everything has to be verified. Capital One continues to be a complete hassle with no rewards.

Capital One knew my wife was a credit risk as she is bipolar and unemployed, but they issued her two sequentially numbered credit cars with a $500 limit. Both of these cards were in my wife’s name and I was never notified that she had these cards. She did well for a period of time, but eventually exceeded the low $500 limit on both cards. This thus, generated large over limit charges and even though she was making payments every month, her dept continued to grow. They then claimed that she had a late payment and added large late payment fees to both cards and jacked up the interest rate to almost 30%.
She contacted them on several occasions to resolve the problems. After receiving no help, she stopped making payments. Soon after they contacted me and initially, I thought that it was some type of scam, as they we nasty and wouldn’t provide information to verify who they were or verify that my wife owed them money. They simply wanted me to give them the full amount of the dept by electronic transaction. The initial $500 dept is now up to almost $2,000 for each card. That is what I call predatory lending!
After I confronted my wife and found out that she did owe money on two Capital One credit cards, I contacted them and found they again wanted the full amount of the debt and had no interest in setting up any payment plan or working with me in any way. They have now filed to garnish my paycheck even though I had nothing to do with the two credit cards that they issued to my wife without my knowledge.

We are a small business that deals in used medical equipment. We purchased 6 parts from a company in CT. We were quoted a total of $9,000.00 over the phone in more than one conversation. We ordered the parts on Nov 20th with a faxed purchase order for $9,000.00 with a 1 time charge of a $3,000.00 down payment on our Capital One Card. Therefore, we should have only owed $6,000.00 via Check, 30 days from the date of the original invoice. We received the original invoice on 12/1/2009. After noticing that the invoice was for $12,000.00, we tried contacting the company immediate of the discrepancy of $3,000.00. The company never returned our calls.
On Dec 20, they proceeded to charge our credit card an additional $9,000.00 without our authorization. They didn't even give us a chance to send them a check, which we were getting ready to write that week, but didn't because we noticed the charge on our Credit Card. I contacted Capital One immediately with all our documentation that we should have only been charged a total of $9K and not a total of $12K. Capital One took the side of the Merchant. Capital One said we could have modified our Purchase Order.
That is not the case. The Merchant has our original purchase order and it states $9K with a $3K deposit on our credit card. I've tried to fight this with Capital One in every aspect I could and they said we have no proof that they didn't quote us $12K. They have no proof that we gave them credit card authorization, the merchant has proof that we authorized a total of $9K to be invoiced, not $12K with only $3k being charged to our credit card.
Capital is fraudulent and I've cancelled all my cards with them and will never go back them. They flat out told me that if I gave someone a verbal price of ex: $500.00 and decided after the fact I wanted to charge $5,000.00, I could because the customer would have no written proof that I didn't quote that. So, I am warning everyone that reads this complaint. Cover yourself and make sure anything you order over the phone or credit card, get it in writing with a valid signature. There is so much credit card fraud out there. I have all the proof including 3 customer services representative that can vouch for the conversation. Nothing counts.

I went through a credit counseling program a few years back and my Capital One credit account was listed as an account to be settled. Through trial and error, and months of payments to credit counselors, I was still being summoned to court by creditors. I finally made the decision to drop my credit counseling program and deal with it on my own. I was told at that time, the only account that was settled was "Capital One". For three years Capital One never contacted me about anything, so I believed it was settled and paid.
Then 2010 arrived! I receive notice from two different collection agencies showing two different amounts owed to Capital One. Both of which have interest for the last three years. I contacted Capital One and asked them if this account was not settled, why did they never contact me for payment for three years? Also, I asked about the 2 different amounts from 2 different collection agencies. No comment was what I got. I explained to them I would have paid it off three years ago when I took care of the other debt (over 30k) $1,800 turned into over 4k with no effort on their part to contact me. I have recently received a summons for judgment on the higher amount (naturally). They are ignoring the lesser amount from the other agency.

Two days in a row now, Capital One has called me up saying that there were some charges on my card that didn't look right. So I call them up the first day, answered a couple of questions. No problem! The next day, I call them back and they ask me who my relative in Maryland. I don't have a relative in Maryland. So they freeze my account, and then tell me I have to go to a bank and get photo ID verification. The two banks I went had never heard of such a thing. Two and a half hours later, they believe me. It’s hard to run a business when your credit card company has you running all over town because they ask you questions that don't apply to me.

I used the Capital One credit card while traveling abroad to get cash at an ATM. They charge $10.00 per transaction, which seems very high and is different from what they charged before. Is that legal? When I returned home and received my bill, I paid it in full, plus an extra $100 to cover any fees they might tack on. When I received my next bill, they had added interest fees anyway, even though there was nothing to charge interest fees on. I am quite sure that charge is illegal, and if they are doing it to thousands of their customers, they are taking in a lot of money illegally. I was not damaged personally but I would like to stop what appears to be an illegal practice by Capital One bank.

In June 2009, I noticed the interest rate spiked on my Capital One card from 9% to 17.9%. I've had this card for around 10 years, always paid on time, more than the minimum amount, etc. I called customer service and was told I was sent a notice in February. I told them I received nothing about any rate increased. They said nothing they could do but that I could try in a few months and my rate could probably be lowered again.
In August 2009, I called again, told them the same thing I told them in June 2009 and received the same response. I was also told that my interest rate could not be lowered at all and the previous agent misspoke. In November 2009 (my birthday of all days), I tried yet again to have things fixed but they would have nothing of it. They reiterated what I had already been told, and their attitude was that more or less, I was [out of luck].
So in January 2009, after I had already cut up the card and moved any exiting auto-charges to other accounts, I drafted a letter to the CEO, in McLean VA detailing my problems. Being nice and courteous about what I have encountered and explaining that I never knew my rate was going to be increased until I saw my bill in June 09 suddenly spike. I received a response a week later not from the CEO but from someone named Kathy A., who is a part of the Executive Action Committee.
They replied with what amounted to being a form letter, about how it is more risky to loan money these days and that even model that rates had to be increased even for accounts in good standing. Telling me that I was sent a notice in Feb 2009 to the address on file, that they show no record of it being returned to them as undeliverable and because I did not contact their automated system by April 17th at 8pm EST, I was basically out of luck.
I replied back to them, this time, sending a copy to the BBB as well. I was thinking that the BBB would have some weight behind them, but I was wrong. I told Capital One that they cannot simply say that because they did not get the letter back, that I got it and I am at fault. They fail to accept that mail does get lost when sent first class mail (if you want someone to get it and be able to confirm it later, send it certified or via FedEx – at least then you have signature proof). Their reply is that they are not changing their position. I rejected that response from the BBB, and the BBB turned around and considers the problem closed and resolved and if I want to pursue further, I should consider legal action.
I will be doing all I can to tell people to leave Capital One and not do any type of business with them. They are nothing but legal thieves. They received bail out money and bought a bank with that money, even though now they claim they have paid the money back. They still used it to buy something they didn't need.

"I have the same story as all others on here about Capitol One. I am a good customer for years and they raise the interest to 17.95 from 9.9%. They claim they sent me a letter a year ago. Who in their right mind if they saw their interest was going up wouldn't close that account? Ok, the economy is already tough and they do this to the American people and say they reserve the right to raise the interest even though I had a fixed rate for several years as well."
Their Executive Response person, whom I was told to get in touch with within 7 days, continues to be unresponsive as well. It is almost as if they are forcing people into default or even worse, bankruptcy. Due to the increase, last month’s payment did nothing but pay interest. My balance unchanged as a result, free money for them. The rate hike also raises my minimum payment well over what I can afford.

They raised the interest rate on my credit card from 4.95% to 15.90% this month! I called them and no explanation could be given as to why, other than saying that they sent out a letter in Feb. of 2009 telling me that my rates were going to go up.
I never received anything with such a statement! They acted as if they could care less! My credit is excellent and I always pay more than the minimum.
My payment also went up! I live on SS and a pension. I can't afford this type of treatment!

Who, in their right mind, if they saw their interest was going up wouldn't close that account? Letter? Okay, The customer service rep was condescending, kept repeating a script, said she could not help me. She said, "call back in the future and ask to have your rate reduced"? I said, "I called you now and want it reduced." She said, "it has to be in the future." Okay, the economy is already tough and they do this to the American people and say they reserve the right to raise the interest even though I had a fixed rate for 5 years. Does that mean I can reserve the right not to pay them? Capitol One, No Hassle? No Way!

Continued calls from Capitol One asking for a "Kirk". I repeatedly answer that "you have the wrong number". The caller did not speak adequate English to be well understood. Three to four calls a day, with the same situation. I finally ask for a supervisor, explained the problem, with some hope this will stop. Capitol One needs to supervise their callers better.

They decided that the whole $700.00 that I owe to Capitol One is more important to them than being fair. I have now been served court papers by the aforedescribed leeches in the amount of some $1400.00, legal fees not included of course. If they decide to continue with this, it will really, really make me consider running for public and political office, the tax payer needs a break from ** like this.

I had 3 accounts with Capital One, Visa and MasterCard. All the accounts were stolen and charges that were not mine were put on. When I reported this to Capital One, they told me to make a police report, which I did. I sent them a copy, they closed the accounts and then they came after me to pay them. This has been going on since 2001. They took me to court over 3 years ago. They lost, they were told by the judge to remove all negative information from my credit report. They never did, in fact, even their attorneys after the case would never answer my attorney any questions.
So last year, I took them to court again. They got a new attorney group. They wanted proof again that these charges in Russia and Minnesota were not mine and many others. We proved it to them again and they agreed that these charges were not mine. They did not want to go to court, they made a document with my attorney stating they would remove all negative information from my credit report, they even signed this document and even Capital executive officer Jonathan C signed it. And my attorney told the court we want this to be monitored by the court until it is removed. At this time, they still won’t take it off my credit report. In fact, they still have their collecting group call me once a week looking for money still.
I called Capital One. They did not have in their records any kind of lawsuit from me and they had no record of any kind of paper work I have with their signatures. I even faxed them a copy, when I called them and tell them that they are making my life impossible to even get a loan. Their attitude to me is very condescending.
They only want to get me off the phone. I never in my life, and I am 52 years old now, came across a bigger group of thieves like Capital One. My next step in about 60 days is to go in front of the judge again, but this time no deals with Capital One. I want money from them. They have cost me now close to $500,000 in attorney fees and extra interest I paid on home loans, car loans, credit cards, etc. that I should not be paying if I had them off my credit report.

By the end of this month, Capital One will cost me in excess of $3,000,000 in lost properties because I don’t have the credit to re-mortgage them.

Capitol One increased APR from 7% to 17.9% just in time to beat the new legislation that would not allow them to do so on past purchases. They knew the legislation was being worked on a year ago that would prohibit them from raising interest rates on existing purchases and only raise interest on those going forward. It is somewhat understandable that they raise interest on new purchases because we all got the memo - the economy is down and don't use your credit cards. But they went ahead and slammed everyone with the increase on everything with the non-customer friendly reason "it was a business decision". Well, the American family's decision should be to drop Capitol One completely. The government should let them fall without any bailout. There should be a national protest against Capitol One, starting today!

It appears to me that Capital One has decided that their customers who have a credit card and always pay their bills on time are no longer worthy clients. My statement for February showed a finance fee for the first time in 10+ years. When I called to inquire, the "customer" representative informed me that the fee is to compensate Capital One for the fact that I am using the card for payments.
From this January onward, the company considers the payments I make as a loan. When I asked why they charge me for the privilege of using my credit card in the way it is intended, the answer was, "We consider it no longer a privilege but a loan." Well, the best Capital One customers can do in such a case is to vote with their feet. I will close the account. There are other providers out there who keep their word when they extend a credit card.

I have been a loyal Capital One credit card customer for probably about 10 years. They have been a pleasure to work with, until now. Between Feb and March of 2010, my interest rate went up from 10.9% to 29.4%, and my minimum payment went from $195 to $380! Old finance charge $93, new finance charge $269, wow! When I called to get an explanation, I was given a condescending attitude.
The rep also claimed I received a mysterious letter a year ago, explaining what they were going to do! I remember no such letter, and if I did read such a letter, of course, I wouldn't still be a customer anyway! It is a comfort to read from fellow victims. I thought I was losing my mind. What a nightmare! I don't know what to do. They did offer to revert to my old interest rate, but I have to close my account! Why would they give up a valuable customer like me?

I was recently laid off from work. I had a $500.00 charge card that the date of due bill was changed without notifying me. I tried to settle for $650.00. No they would not settle. Next thing I know Capital One garnished my savings account with my son's name on it for $1,447.00. That is 200% interest. How can they charge that much money for a $500.00 charge card?

I called Capital One to report fraud on my account for $230.00. It's not much, but a lot to me, and I was just accused of being a liar, and was harassed at work by Rachel. I turned in all the required documents. The bottom line is, it is more stressful dealing with them. I just decided it was not worth the stress, and decided to pay the charges, and just close this account, and never have to deal with this crazy company again. I would never ever recommend this bank to anyone. Leo, the manager, was no help either. What terrible service! It was very stressful, and emotionally draining to me and my husband to deal with. This is a company that treats their customers badly.

I just got off the phone with Capital One. They have raised my interest rate from 6 to 18%. I asked them if I closed my account what would the interest rate be, 18%. The girl started reading a script and I told her, don't read a script, work with me; I've been a local customer for over 10 years. She told me, "sorry, I can't do anything for you". I even requested to speak with a supervisor and she told me, "she can't help you either"! I have been a loyal customer, paid more than the minimum and on time every month.
I was told that it had nothing to do with my payment history and that I was a good customer. They said I was sent a letter to opt out over one year ago in Feb, 2009. Who remembers that or even if I really got such a letter 1 year ago? This is their legal loop to get away with such ** I hope NO ONE does business with Capital One - I will not charge $1.00 with them again!

My Capital One credit card interest rate increased nearly triple, despite my paying on time, and always more than minimum payment. This is a despicable business practice, since supposedly, we are being protected by the new law. Supposedly, we received a notice of interest increases a year ago. I have all correspondence, notices and statements for the past 2 years, and find no notice of interest increase. What is going on? I will be paying three times the interest amount on my balance, and will take forever to pay off my credit card. I wont be able to use my card any longer, as I simply can't afford to now. The new interest rate will take up about half of my payment.

Capital One more than doubled my interest rate on my credit card for no reason at all. I also was never notified that my rate would be increasing. I can barely afford to pay my bills now. If I have to pay twice as much interest every month due to an unjustified rate increase of double what it was, I will have great difficulty in making the minimum payment every month.

Three times I warned them not to call. But at 8:44am, and twice at 9:27am they did, Friday today. Arrangements were made online through their internet accounts receivable that a payment is set to be made on 3/12/2010. They repeatedly call me at home and on my work/personal cell phone number after my warnings. Please pursue action against them for ignoring my warnings not to call me again either at home or at work repeatedly.

My 7 year old grandchild keeps getting credit card applications. I tried to get this stopped, but calls to the opt-out number requests her SSN, which I will not provide. I have tried a number of ways to speak to a human, but always get a recording. It may potentially adversely affect her credit, should the wrong person get hold of one of the applications and fill it out.

My credit card interest rate was 7.9% now my March statement has jumped to 17.95%. I have always paid more than minimum and early, never late and never even close to my credit limit. Called Capital One and was given no reason other than "bad economy". I thought the new laws went into effect in February where they could not do this? My finance charges have gone from $29.66 last month to $68.64 this month. Interest rate has more than doubled.

I had a Capital One credit card. In 2006-2007, I was covered by their payment protection plan, or so I thought. They charged me for this service, but when I was no longer employed, they told me that they could not cover me because I did not work full time when I applied, only part time. Well, they knew this when I enrolled in their payment protection plan and they still charged me every month. A professional just recently said that if what I am saying is true, then this is a case of fraud.
My account is closed but it seems as if they are still adding on interest charges. Do I have a case against them? They have filed a judgement against me for $1,751.17 and my credit limit was $500. I tried to protect myself in case of unemployment, but they obviously deceived me. My credit is damaged because of this and it could have been prevented if they honored the terms of their payment protection plan. I also owe them over twice as much as my credit limit.

I had 4.95 interest rate locked in since 2006 and have once paid it off--then, I usually pay extra. Now, they raised my interest to 15.99 percent. It is outrageous. They told me that they could not give me the reason why my interest rate was raised. I said it was my account and I had the right to know. She said, "We are unable to release that information."

I have been a loyal Capital One customer for many, many years, with two credit cards. My rates were raised from 5.9% to 15.9% on existing balances (one card in fall 2009, the other in February 2010). I even paid for a full credit report today, including my credit score, to make sure they didn't have a justification to raise my rates. As I suspected, everything on my end was fine. My credit score, rated "excellent," it's in the top 2% of U.S. consumers. So having good credit equals paying off Capital One's bad debts. I am paying off one of my cards over the next two months and searching for a low intro rate with another company for the other. I refuse to do business with Capital One for a minute longer than necessary. I hope they go out of business in shame. And this situation was handled very badly by the current presidential administration. It ended up hurting consumers much more than it helped them.

When I received my March statement, I noticed that they raised my interest from 14.4% to 22.9%. I called and spoke to Sara and Ann, I received two different stories, one, that they will be reviewing my account and lower it back down in a few months and the other, that it was raised due to inactivity, and they stated they sent a notice out in February. I never received this notice.
So on 3/3/10, I called and requested for a manager and spoke to Aaron. He stated that he would give me the opt out option even though the deadline has passed. I agreed to do this because they would, in no way reduce my rate otherwise. So on 3/3/10, I closed this card and agreed to pay the balance at the 14.4% interest rate. I want to post this so that if a month or more down the road, they try to change their story because I was given so many different ones while talking with them.

Capital One raised our interest rate from 10.9% to 17.9% in Feb 2010 with no warning. Now, we are over our limit. We have always paid on time actually making every payment earlier than needed. Always been in good standing even have a car loan through them which payments are always on time. So why are we being penalized with no warning? Now over the limit and no notification to opt out.

That is why I was using revolving credit until graduation to begin with!

I recently wrote in about Capital One telling me that I would "never" be able to pay off my credit card if I paid only the minimum payment each month. This was on February 22, 2010. According to them, it would take "forever". They did not have an answer for me when I asked why they didn't just raise my minimum payment. I checked my credit card account balances today and discovered that one was "currently restricted". I called the company to find out what that actually means and why it happened.
I was finally transferred to someone whom I could understand (Christy) and she told me that I had called earlier today and requested to "opt out". I have not spoken to anyone at Capital One since 2/22/10. According to her, I filled out a bunch of paperwork and requested that my account be cancelled, so the account is now restricted and the previous interest rate has been reinstated. I did not call them earlier today, and I did not "opt out". In fact, I had called last year to ask why I never received an opt out offer. They said they sent it and it must have been lost in the mail. At that time, they refused to let me opt out because the deadline had passed.
I believe that Capital One is now doing this because they do not want (or maybe do not know how) to list "forever" as the payoff time for the minimum payment. It appears that Capital One is getting more and more crooked as the days pass by. I thought that the credit card act was supposed to help people. So far, all it has done is hurt me. I am waiting to hear from Capital One's account manager who is supposedly going to call me back in 1-2 business days. I have a strong suspicion that I will be canceling both of my Capital One cards in the near future.

I obtained a Capital One rewards card for my business, which does $1.4 million in revenue annually. I was hoping to rack up some miles with that kind of spending power.
Unfortunately, the card came with an absurdly low $500 limit. My credit is absolutely pristine, and my income is good, so that didn't make any sense to me. I called and the representative told me that they would promptly review the account for a credit line increase. I put $500 on the card and immediately paid it off via EFT from my checking account. By immediately, I mean I did it within 24 hours. I waited a full week for Capital One to post the payment and release me to again use the card.
After a week, I called again and the representative contradicted what the earlier rep had said and told me that Capital One won't consider credit line increases for any account less than 12 months old. When I asked her why my account still showed zero available credit a week after the payment was posted, she told me that my account was "on-hold" because I had actually paid my bill so fast! I told her that I intended to use the card and pay it off over and over again every two or three days, because the limit was absurdly low. She snappily told me that my payments would be held for at least a week each time! I told her that made the card essentially useless to me and closed the account immediately.
I don't expect special treatment because of my job or my income but every consumer is entitled to quality service, not snotty representatives who lie. We're all entitled to prompt application of our payments. Stupid, stupid decision Capital One. I'll take my sterling credit rating and purchasing power to a company that treats me the way I treat my customers, with respect.

I became ill in early 2009. I was in the hospital eight times. I am on disability and make $978 a month. I have faithfully been making $50 a month but with their finance charges of 29.7% and other charges, I owe more than I pay and they will not work with me. I have a Capital One credit card which I used more often, but lately, I have kept it as a backup card because they jacked up my interest rates from 8.9% to a whopping 17.27% for no reason! I have been with Capital One for over four years and have an excellent credit history. I have never been late on a payment, have a credit score in the 750s, and have a steady source of income.
When I called to ask them to honor the rates that they are offering new customers (11.9% variable, which is still high), I was told that they are unable to lower the rates at this time. I then asked if my account could be transferred over to become a 'new account' to take advantage of the 'better' rates. I was again told that they would be unable to do this. The only option I was told was to close the account and apply for a new card.
Let's analyze this for a moment. Here you have someone who is credit worthy, a good customer, etc., and they are turned away for reasons that have nothing to do with them. I understand that there is a high default rate these days, and credit card companies need to protect themselves, but this is not the way to go about it. I understand that hindsight is 20/20, but if you wanted to protect yourself, you shouldn't have extended credit to people who were clearly unable to pay it back.
You make money when people pay back with interest (principal and a reasonable 7-10% interest), not when you charge 17-25% interest and have default rates of 10.4% that keep rising and you get calls from credit consolidation and default agencies that give you $.30-$.50 cents on the dollar. Please don't make me pay for your stupidity.
Another caveat: if I close my account, it can affect my credit score because it will reduce my outstanding credit available, as well as my number of years with that line of credit open. Maybe that's what the banks want--people who are creditworthy to have lower credit scores so that they can charge them higher interest rates when they apply for new cards.

Please help, I am at the end of my rope. On Feb. 5, I call Capitol One to close my account and pay off the entire balance. Tyler told on the 6th everything would be closed. In other to do this, I had to pay about $3.58 over my balance to close it out completely and it would close the next day. A week or so later, my account was still open and through talks with Debbie, she stated he made a mistake and as soon as the account was refunded it would be closed. Linda (am a manager took over and said it was the system to blam and she couldn't do anything. When I said she should top blaming the system, she hung up on me. At the time she was currently writing the check out and the account would close in days. It was the system to blame and not her and that Tyler had lied to me about the extra amount needed.
Over a week later, the check came but the account remained open. Now as I look tonight, I have a new balance due of over $10 and after speaking with Megan another manager) she said, they may have lied in the last but she was for surely not lying that she would remove the the fee but it would take a month for it to clear before the account could be closed. I want out of this bank that has no regard for its customers. I have done my part several times over and I am tired of charges that should not be made after the account should be closed.
This is an abuse of power on their part. With balances on my account, they cannot close my account. I am finished with company. I also feel that they are using me. I have been a loyal card holder for years and deserve to be treated as such. I know they are losing people due to knew credit card rules and this is the last way to try and keep them. Please help me. I have no other excuse besides a lawsuit for harassment, and unnecessary stress and harassment. Stephanie also seems unwilling to address any concerns as to how my account has been hijacked by Capitol One to do whatever they feel they can to collect more money from the struggling consumer.

I activated a card. They told me I was all set. I asked if I could go to ATM to withdraw funds. The answer was “Yes, you’re all set.” I went to the bank. I was declined. I called Capital One. I asked what the problem was. They replied it was too high of an amount for first time use. They canceled the card. Their slogan is “no hassle”. Well, all I got was a lot of hassle. Capital One has started charging interest on my purchases from the date of purchase, which is just greed beyond belief. I always paid my balance in full every month to avoid paying interest. This new way of ripping off the consumer is in addition to the 2.5% to 3% they charge the merchant who accepts the transaction. I have cancelled both of my long time Capital One credit cards as of today. I will cancel all other credit cards that pull the same stunt. I would advise everyone to cancel any credit card account that is abusive to you, and that is most of them.
Pay by check, cash, or don't buy. Capital One hurt themselves, not me. Fortunately I am in a position where I don't need Capital One credit cards. They need people like me, whom they will be losing in droves. The only accounts Capital One will be left with are credit card customers that become charge-off accounts. No one with good credit and the ability to pay in full each month is going to put up with this greed.
Washington has not gone far enough to regulate these greed, and I suggest that everyone write their State Senator to complain that more regulations are needed with the banks and credit card companies. I will never do business with Capital One again, and will post on as many sites as possible, and let others know of the usurious and greedy practices of Capital One. I have been a loyal customer of Capital One for about 3 years. I use them because my interest rate was a low 4%. I have transferred balances from other cards to consolidate my debt and pay it down responsibly. You could imagine my shock when I went online this month to pay my bill and found that my minimum payment had more than doubled because my interest rate went from 4% to 14%. There is also a warning on my statement saying that if I fail to pay on time, I will be charged a $40 late fee and my APR will go up to 30%.
When I spoke with Capital One they told me that I was sent a letter a year ago explaining that my "promotional rate" will be ending in February 2010. I never received any letter informing me about this change, and was never on a promotional rate (4% was my rate for almost 3 years). In my opinion, if such a letter was ever sent, it should have been sent registered mail, to ensure customers genuinely received it. If any such letter was sent, I suspect it looked like an advertisement rather than an extremely important letter.
Furthermore, I was under the impression that these whimsical rate hikes were illegal following the new legislation. When I spoke with Capital One they explained to me that the decision had nothing to do with my payment history (which was on time) but that it was a business decision because in the current climate it is risky to lend money. I was not a risk to them before they hiked up my rate. Now I am, because I cannot afford to make the new minimum payments.
I have since learned that Capital One received over 3 billion dollars in bail out money from the federal government. This rate hike is unjust, immoral and a gross abuse of power. I have also learned that the new laws go into effect in June 2010. It's legislation like this that allows these companies to stick it to people while they can. The bottom line is that they increased the rates now because they know that once the new law goes into effect they can't change the rates.

I called to find out the payoff balance, and I sent them the exact amount via EFT. And then, I got another bill a month later indicating I owe $76.75 in interest fees, even though my balance is a zero. Interest rates jumped to $15.90, despite sending more than minimum payments for several years, and they are now charging interest on a zero balance!

I have been a customer for 13 years! They raised my interest from 14% to almost 23%. It has nothing to do with how long or how you paid your bill. I have never been late or missed a payment in 13 years. I always paid more than the minimum. I have charged my card up to $6000 and have paid it off 4 times over the years. My balance is up to $4500 right now. I would have never charged that much if I knew they would do that. I called and she basically told me that new customers could get lower rates and some 0% interest but all other customers with or without good standing would have an interest hike. I said fine, move my balance to a new card. No, she said there was nothing she could do and yes, I heard all about the ** letter. They are the scum of the earth. If only we could get a news magazine to expose these people for who they really are, that would be gratifying!

Last year, my interest rate from Capital One was 9.4% on purchases. I did receive a letter with an option to opt out from my credit card in April 09. I did opt out and closed my acct. In February 2010, Capital One doubled my interest rate to 18%. The many times that I called them, I was told there was nothing they can do. Is this fair? My acct. was closed for over a year, and they still doubled the interest rate. I hate Capital One, and I suggest to everyone who is thinking about opening an acct. to think a million times over before doing it. I have been unemployed for over a year now and have been struggling beyond my means to pay Capital One. Now that the interest rate has increased, It will take me many years to pay them off. I have been a credit card holder for Capital One for approximately 15 years and have always paid more than the minimum amount due and owing on each of their statement. Capital One credit card statement ending January 21, 2010 stated, "As previously disclosed, your promotional rate will expire soon. Please remember that beginning in January the rate that will apply to balances subject to the Purchase and Balance Transfer rate will be a variable rate. As of 11/25/09, this rate was equal to 15.9%."
I was never notified that my rate would increase from 4.78% APR to this rate. After speaking to Capital One representative and then to her manager, Shelly, I was informed that a letter had been mailed stated the rate was going up. I am sixty-two-years-old and have always taken care of my debits. No letter was received stating that my interest rate would increase to 15.9%. Shelly, the manager, would not even talk to me relative to closing my account and keeping the old interest rate of 4.78%. They will say it is a "promotional rate". Believe me, if I knew that rate was going up, I would immediately close the account. The highest rate of interest that I have paid within the last twelve months (12) was the 5.9% which was for February through May 21, 2009.

Annual Percentage Rate (APR) interest rate went from 9.79% to 17.90% on February 23rd 2010. Account paid everyone on time. Spoke with a representative on the 17th at Capital One was told my rate would not change. As a result, monthly payment will be difficult to make, I will not make future purchase with this card. It will take a lifetime to pay off. Now if I close the account, it lower my FICO score, I won't have available credit if needed as in the past. Punished for paying my bills in time. "Thank you for calling Capital One you have been a great customer." If so then put my rate back down. Economic damage. There will be another downward spiral that will result from millions more upstanding citizen not being able to make their payments and lose even more. Not to mention, no more donations to the elected officials who let us down.

My story is the same as others responding to the interest rate hike. I called Capital One today, and I explained that I am paying more than minimum and that is all I can afford since I live on social security and over 70 years of age and that not to expect more than that amount. My monthly minimum went up $79.00. I wish they would stop saying "I understand" when they do not have a clue and "I'm sorry" at the end of each sentence.
Now, I will be accumulating late fees each month which will affect my credit score. I was told that after a few months, arrangements can be made; and I was given a 3rd-party debt agency phone number. But by that time, the fees will have added up and I will be in over my head. It is easy to say you can opt out, but if we could have paid the account in full, "opted out" of course we all would have and there would be no need for credit cards. Thanks for letting me vent.
Credit card hell is aptly named. I wonder if the top execs will be receiving a mega bonus again. Since I am continuing to pay the $200 a month (over the monthly minimum), monthly the late fees will add up and my credit score will be affected. Also, my peace of mind will be gone watching the process spiral out of control.

I received my credit card statement this week, along with the notice about the changes that had been made to it to meet the requirements of the new credit card act. The section that explains how long it would take to pay off the balance if you just made the minimum payments each month was missing, so I called Capital One to find out why. The first person I talked with, Kim, wasn't sure why it wasn't on the statement, but she was able to tell me that (according to their calculations) I would "never" be able to pay off the balance.
I already figured that was true, but I was shocked that they would actually admit it. She transferred me to Marie to see if she could tell me why this information wasn't on the statement. Marie wasn't sure either, but she said that their records showed that it would take "forever" to pay off the card if I only make the minimum payment each month.
Eventually, I spoke to Teresa who told me that it wasn't on my statement this month because the statement was issued about week before the credit card act took effect. Several times during the three conversations, I asked why they didn't just raise my minimum payment so that I would eventually get it paid off. I got several lame excuses, but I guess we all know why they don't do that. I guess I should have been mad about the whole thing, but it was rather amusing. I'm paying huge chunks off of all my cards this year until they are all paid in full. I'll keep my credit union card, but the rest are going to be cancelled. I think we should all get out while we still can.

I just opened by Capital One Credit Card as I do every month at this time to pay, I always pay more than the minimum also. My interest went from 4.82% to 15.90%. I called and spoke to Vans, employee #GNC016 and she stated, there was nothing they could do, that I should call back from time to time and see if they might could help me.
I stated that it would be better to move my low amount owed to another card with lower interest and she stated she thought that was exactly what I should do, because Capital One not able to negotiate the rate, been with Capital One for years, over 15. I asked to speak to her supervisor and she reluctantly gave me to someone else, and he stated I received something over a year ago, that stated I was to call a toll free number and could have opted out of this rate, but my card would have been closed.
So basically I asked him, Capital One wants you to either close your account or pay much much higher interest, he stated there was nothing Capital One could do. January a year ago, Chase tried this and got sued, I hope someone takes on Capital One. I will be paying off my account as they wish to not have customers that use their service and pay on time and more than the minimum. Thanks a lot Capital One. Interest Rate raised 11% that states a lot, when I am a public servant and work for the State, we don't exactly make that much money. I have been there for 20 years and have 2 kids in college, that I pay for. That 11% may just keep my kid from college.

Overcharges for over limit and past due fees accumulated amount of approximately $1570.00, when the initial amount owed was below the credit limit of $800.00. Capital One charged the amount of $110.00 per month claiming $39.00 past due fees; $29.00 Capital One Membership fees; $39.00 over limit fees including finance charges of $40.75 to $40.00. Periods of unemployment occurred and only minimum payments were made. Despite these payment, Capital One attached over limit charges on past due, member fee and over limit, and also demanding payment not on product/purchases, but on over limit, past due fees and finance charge. Capital One Bank received $3.65 million in economic bail out from the federal government. I am asking for a bail out forbearance or an agreement to pay the maximum of $300.00 as a settlement offer in this matter as a relief to this debt demand. Please help me in this matter to consult with them. Thank You.

Capital One CC. My rate just went from a 10.9% fixed rate to a 17.9 VAR% rate. I called them and they refuse to work with me. I have been with them and paid on time for 5 years. Other CC sites have them as being one of the lowest CC's you can find at 13.9%. They would not even give me that rate. ASAP I'll be ending my relationship with them and will never do business with Capital One again! This is going to cause economic hardship for myself and my family.

What a mess! It was my understanding that the legislation changes to credit cards was supposed to help the consumer, not hurt us! In one month, Capital One raised my interest rate from 12% in January to 22.9% in February. This is just wrong. In speaking with the representative, she stated the reason is that lending is harder and spending is down. Oh well, the slump in the economy should be shared by all.
These high interest rates are paying bonus to their employees. I am currently unemployed and have been making it a priority to keep my credit in good standing. I have been a loyal customer with Capital One for over 15 years, paying on time, more than the minimum due, and although the interest rate has gradually increased over the years, this one really angers me because it has doubled. I was told that it had nothing to do with my payment history and that I was a good customer. They did nothing for me however, and said I was sent a letter to opt out over one year ago in February 2009.
If I was a day late on the card, they would be calling me on the phone and charging a late fee. This major change deserved a phone call. Who remembers a bunch of junk mail with small print, with a bunch of legal jargon over a year ago?! This is deceptive practice and Capital One should be held to account. This is really taking advantage of consumers that are already struggling. I have elderly parents that I bet missed this transition too and they are on fixed income. Something has to be done to stop these unfair practices. What I had budgeted to pay off the end of the year is now going to take much longer. This is ridiculous!

Recording the conversation, I told Capital One that I am unable to pay any additional monthly payment from 2 months ago. I am currently making $20,000 less than I was 2 years ago. I explained to Capital One today and 2 months ago, changing my rate from 6% to 15.9% is impossible for me to pay, this raises my payment from $159 to $247 per month minimum payment. Stevey said, “We cannot change the payment structure.” He refused to put the old rate of November 09 back into effect. I told him that if a stress issue develops, that Capital One will be responsible for my health issue. I was told by Capital One that I am one of their longest holding card users.
My credit history today is in the high 700's. This episode today is going to change my future credit rating and my health. I told them it is impossible for me to pay them, that I would continue at the past rate. As of today, I told Stevey that I will not make any payments, that a collection agency will be in touch with me in the future, and I will negotiate with the agency that I will pay the balance of November 2009, that I will pay back at 6%. Is there anyone else that feels I am wrong beside Stevey of Capital One?

As I can see from all the posts regarding Capital One, I am in the same boat as all of them. Whereas Capital One, effective right before 2/22, changed my APR from 8.3% to 17.99% adjustable. It's outrageous. I've been a valued customer with them since 2002, paid my bill on time, have always paid more than minimum, and even when they reduced my credit limit from $15,000 to $3,400, didn't make a big deal about it. This is absolutely wrong. They too claim that they sent out a notice back in Feb 2009. I know with my other creditors, I received a notice to opt out, and I did just that. Had I received this, I would have done the same. Is there any way for all of us to bond together, and fight this battle out. This new act was supposed to protect us.

I always monitor all of my financial correspondence carefully, and save all TOS and the like that I receive. I have specifically been looking for notices of rate increase and changes for all credit cards I have, and have seen several, which I have filed. I have a balance on one card, Capital One, which, ironically, I used for legal retainers. As Capital One had sent no notices for rate increases (although numerous offers for balance transfers from "higher rate" cards), I kept the balance on this card with its 6.99% rate. My statement which closed on February 17, 2010, had a 17.9% APR, which on the new format bill indicated that the APR was based on the Monthly Prime plus a "margin which has been disclosed to you earlier".
I called Capital One to find out 1) when this margin was disclosed to me and 2) what the "margin" amount was. I was told over and over that a letter had been sent to me in February 2009 stating this margin. However, none of the representatives I spoke with was able to tell me what this margin was, despite their insistence that I had been notified. I said that I was able to access, online, every single statement from February 2009 until the present, and also that there's a "Messages and Alerts" section online, which contained no notifications whatsoever. I asked why it was that I was supposedly mailed a notice in February 2009 for a rate increase 12 months in advance, but nothing was made part of my online record.
I repeatedly asked what proof they could offer that I was actually sent such a letter, and robotic-like, was repeatedly told that there was a "note in my file". Nor was there an explanation of why a letter was sent but no online record in my account, while there are online records of all statements. She was clearly reading from some kind of script, and when I asked how to contact their legal department, was told, "We don't have one." I repeated, incredulously, "Did you just say that Capital One has no Legal Department?
Well, I'm quite sure she's incorrect on that count, I requested a copy of this alleged notification, and after being put on hold for a long time, was told that the letter had been requested and should be received in 14-21 business days. I have the representative's name and ID number (I had been escalated twice, so hopefully she was somewhat senior), and asked if my call had been recorded and was told it had been.
At that point, I repeated every point I'd gone over in all my conversations with various representatives, and asked her to verify her and Capital One's position on the issues I'd discussed. I also asked her to verify that there was a record of our conversation both on voice record and an online record in their system, so that it can be referenced at a later date. I'm sure they'll be able to come up with a letter stating I was notified of a rate increase, but I question if it wasn't in the guise of yet another offer of a balance transfer or otherwise deceptive notification from Capital One. In any case, a notification one year from the date is certainly deceptive if not downright illegal. I see there are numerous similar complaints on this site, so it appears that Capital One attempted to get a jump on legislation with their best customers. Go figure.
I've been a customer for over a decade, with no late payments ever. Of course there have been many times over the years when I've carried no balance, and with no annual fee, not provided Capital One with any appreciable revenue. I've been deluged with additional offers from Capital One the entire time I've been a customer - it was in fact one of these offers of "checks" that I used for a legal retainer for representation in a wrongful termination suit for my husband (litigation is ongoing). At this point, I'm looking at nearly triple the APR, with my only transgression being a good, on-time paying customer. At this point in time, I'm not in a position to pay off the balance, but hopefully may be able to do so shortly as our litigation proceeds to a settlement, so that I can permanently cease to do business with Capital One.

I have a Capital One credit card. I was guaranteed a zero percent interest rate on my balance until 3/1/10. My Feb. statement indicates payment due date is 3/14/10. On 2/24/10, I called to pay the amount due and I was told that if I paid the entire amount owed, I would still have to pay an interest charge from 2/17/10. I asked how that could be when the zero percent interest applied until 3/1/10 and the payment wasn't due until 3/14/10. The rep said Capital One charges interest in cycles and the cycle ended 2/17/10 and I should have paid the entire balance two cycles ago. I had no information regarding this policy.
I asked how would I know that when my statement indicates no payment due until 3/14/10. Rep just keeps repeating this is their policy. I called back twice thinking the previous reps must be wrong. But each time I called, I was given the same story. Under the Federal Reserve new Credit Card Rules, this practice is illegal. I had an agreement that I had zero percent until 3/1/10. The new rules indicate "No increase in interest rates for one year." My one year was not up until 3/1/10. I intend to dispute any attempt to collect interest charges and I will report this practice to the Federal Reserve, but I want as many people as possible to be aware of Capital One's misleading offers.

My mom has a credit card and the interest rate went from 10.9 to 17.9. We (mom and I together on speaker phone) called last evening and pleasantly asked them to lower the rate and were transferred to supervisor Veronica. She asked what the card was used for, what kind of purchases (none of her business), if she had other credit cards such as Home Depot (relevance?), commented on how long she had had the card (since 1996), good payment history, etc. At that point, I injected that the reason for our call, again, was to request a lower interest rate. She reminded us that the change in terms was to be effective 2/10 and we were notified (yes, agreed) and they would not change the interest rate because the change in terms had just gone into effect.
I asked for her supervisor. She said she was a supervisor. I again asked for her supervisor, at which point she transferred us to (ready?) some off-site transportation company where someone named Ian answered the phone and said he has nothing to do with credit cards. That was how this "supervisor" handled our request, by blowing us off and transferring us along to some outside phone line that had nothing to do with Capital One. At that point, we were on the phone for 23 minutes in total. I just gave up. I feel so frustrated right now I could scream. How dare them.

Capital One waited until the end, but like every other CC company, it jacked my rate up over 10% today. I keep good records and have my letter from January 2008 when they stopped my fixed rate and went to a variable rate (LIBOR + 5.050%). I had noticed on my last two statements the notice that my promotional rate was going to expire. I didn't take any action, because I didn't think I had a promotional rate.
When I called them tonight, they said they notified me in February 2009 that my rate would be going up this month. Correct me if I'm wrong, but Congress didn't pass the new consumer CC protection bill until May 2009. How did Capital One have it timed out to jack everyone's rate up three days before the new law went into effect? Did anyone receive this mysterious letter that Capital One claims they sent out in February 2009? I have no idea what to do next. I do know that I will pay off and drop Capital One.

Upon opening my account, we have had several problems with Capital One. To name the chief one, it would be a Guaranteed Lifetime Interest which does not exist. But to further specify the problems I have had with this company, I will just narrow it down to today's issue. I called Capital One because I had paid my balance off and was waiting for it to be closed. I went on the internet to check the status and not only was it not closed, it had a fees and interest charge on it. Well, I called customer service to find out why there was a charge when I paid the balance in full and was able to speak with a supervisor, David, who informed me that I would have to pay that in order to close my account. I asked why and he said it was interest. How can I have interest on a zero balance? He gave me some line saying that it was how the system is set up.
Well, we went back and forth because I didn't understand how I could pay a balance off completely only to be told that I have interest on a zero balance. David then began to talk louder and slower like I was mentally challenged and began to be sarcastic. Getting nowhere, I put my husband on the phone and David proceeded to get even more belligerent and rude. After several minutes of this, my husband asked to speak to his superior and was informed that he had none. Needless to say, we asked for his employee number which he gave us the call number stating it was his employee number. We informed him we would be contacting corporate. Once my account is closed, I refuse to have any more contact with this company. I think they seriously need to retrain their customer service departments. They are completely unprofessional!

Capital One raised my interest rates from 6 to 16% in February 2010. I did not think that was even legal under the new legislation. I was a loyal customer, paid more than the minimum and on time every month. I was told that it had nothing to do with my payment history and that I was a good customer. I have had my card for 4 years. I paid on time every month, more than the minimum payment, and in some instances, paid them more than once a month. Capitol One's answer to their good customers, hike the rates from 7% to 17% and assess an "interest" fee on February 18th. Thank you, Obama. School teachers, as you mentioned in many of your speeches, don't make a lot of money and this is the reward we receive for diligently paying our credit cards. Again, like the rest, I called Capitol One and there’s nothing they are willing to do. Sounded like the woman was reading from a script. Yes, Obama, let's boost the economy by making it impossible for people to spend money now. I told Capitol One that the card would be paid off and then closed. I don't need this. Talk about usury rules. Wow, welcome to the new America.

For the last 4 or 5 years, my wife and I have each been getting envelopes in the mail, at least weekly from Capital One. On the envelope in bold letters is You are approved. Simply put, anyone could call or fill in the application. For fear of identity theft, last week I chose to call the 888 number to opt out of these mailings. To my surprise, the recorded message was from the three credit reporting agencies. They either give or sell your address to insurance companies and companies offering credit. I opted to have this stopped for 5 years. Is there some way this could be controlled? Your credit rating drops when your identity gets stolen, and the Credit Reporting Agencies, are the ones that are handing out your address freely. At least, promote this opting out option to consumers, it's easier than shredding all of your junk mail, and praying that no one steals your mail. Thanks.

I had two Capital One cards for 3 years. Between that time and now I opened a Discover, Merrick Bank Visa, Home Depot, Lowe’s, Macy's, Amex and Chase Bank cards. My home income exceeds $120,000 a year. My Capital One cards had low limits of $750.00 and $1,750. My other accounts all have $4,000 to $17,000 limits. Keep in mind I had Capital One cards first. All my accounts are paid off end of the month. I called and explained I wanted to increase my limits. I explained limits are very low in relation to my other accounts.
I wanted to keep my Capital One cards and maybe close other because we travel every year to Cebu, Philippines and they have no foreign exchange fees but their credit limit is too low to bother keeping. Can they please up them to $4,000? I was flat out told no twice! To make matters worse I had to call twice to close both cards but they only can do one at a time! They lost my business. I’m a 3-year card holder with great standing and six-figure income. Go figure!

Boy, Obama really ** up allowing so much time to pass with the Consumer Protection Act. Enough time for credit card companies to completely ** the public. Capital One raised my rate from 9.9 to 29.4%! I checked and payment was received 10 days before due date. I called them and was told just like a lot of people they had sent a letter last February! So just before the act takes effect they raise my rate 20%? Great credit always on time, same old story. Just a completely greedy bank that just like a lot of others is putting the tarp money to good use. This economy will never get better with what is going on! They raised rate 20% which is just fraudulent and pure greed.

My wife and I have been with Capital One charge card for almost 20 years. Our interest rate went from 9.9% to 17.9% which is just in time to beat the Obama regulations. Too bad the Obama people were so naive not seeing this immoral act of greed coming. We now have nothing but contempt for Capital One. If I could pay off the cards, I would just to get rid of this disgusting company. I can tell you this; I will never ever deal with Capital One again. I will warn everyone I know what a despicable company this is.

Capital One just raised my interest on my card from 8.4% to 17.9%. They sent me notice of change in terms in january of 09. But it wouldn't take place until Jan 2010. I could of opt out by April 17, 2009. I did not. I wanted to keep my card and I knew the new credit card rules should help me from capital one raising my interest. Well SEC 171 subsection (b) was used to get what capital one wanted. However, my concern is that the new rules did not apply until the president signed the bill in May of 09.
I don't see how capital one can raise my rate in Jan of 2010 when the new rules were in effect. They state that all retroactive rates are banned with few exceptions. They do not affect my situation. Had they said they were going to raise my rates after the bill was signed into law then I could of understood what my rights were and would of opted out. I thought the new law on credit cards was going to stop me from getting my credit card rate increased. I called Capital One and asked to opt out now and they said I could but it would be at the higher rate of 17.9%.
I refused to opt out and have contacted my senator and the department of federal government that oversees capital one on gov rules and regulation. I hope that capital one gets what they deserve. A lot of people are fed up with getting bullied around. If they can raise my rate during a time when they should be lowering it because of the economy and they ignore the government and the bill signed into place then they have a lot more power than they should. I am trying to get my 8.4% interest rate back. Oh yeah, they changed my purchase rate to a "promotional rate", there must of been something behind that because they did it before they raised my rate. If they really were concerned about the economy they would lower all card rates.

I have had a Capital One Card for 4 years. My rate was 9%. This month, it went up to 18%. It doubled. It took 3 years to get it down to 9. I called and they said 18% is the lowest they could offer (like it was a favor), and this is a business decision on their part. There was nothing they can do for me, and they have done this to many customers, without a review. A year ago I was given a letter. If I didn't opt out, it's too late. I'm anal about reading my mail. I received no such letter. Within 6 months, I'll go into the red with the interest rates this high. I have no choice but to do everything I can to get Cap. One out of my life. Given the stories I've heard when you don't cancel with them, fraud happens, and they find other things to surprise you with, and charge you for, I will cancel and take the credit score hit.
According to the customer service person I talked to today, she plans to tell every single person there is nothing she can do. They got their letter, and now it's too late, and that people are lying when they say they didn't get it. What an interesting way of doing business, forcing people to not do business with you. Are they vetting out people whole carry balances, using that to get as much money as possible from them? Why should I pay for their business issues especially with a credit score in the high 700's, whatever that means anymore. My credit score was threatened. I will need to leave this credit card company as soon as possible, to not cause going in the red. They've backed me into a corner. I will need to cancel, because now, I do believe the stories, that if you don't, they will keep trying to steal from you.

I purchased an aid premiums for "credit protection" on my account for several years to protect my credit in case of job loss due to disability or when I became disabled and unable to continue working. I tried to get them to activate my insurance, nothing. They have libeled, slandered, refused to activate the insurance, caused my credit score grievous harm, probably irreparable. I looked into and found it's common for them to do this to elderly and/or single women a lot!

I have had a Capital One Bank Credit Card for several years. In April of 2009, I closed out this card, with a balance to be paid off, and an interest rate of 10.99%. I was told the interest rate would not change during the time it took to pay off the account since I had closed it. Last week (February 12, 2010), I received a statement and they have taken my interest rate up to 17.99% and significantly raised the minimum payment due. I have never missed a payment or been late with a payment so there was no cause on my part for this action.
I called them and the customer service people were like robots. They insisted I had received a notice from them 10 months ago and that I had until July of 2009 to respond to prevent an interest increase. I save all my correspondence from credit card companies I deal with because of situations such as this. There was never any such correspondence. I talked to two different people, both of whom said that since I didn't call by July 2009, the interest increase that just showed up on my credit card could not be reversed.
This company is engaging in what I believe to be illegal practices, certainly immoral ones. I would like to see them investigated. I would be happy to provide any information to an attorney investigating this. I encourage all consumers who have accounts with this bank to close them, and all consumers receiving solicitations from Capital One to discard them without responding.

I called in to have my interest rate lowered because of a few late payments it went up. I explained to them that with the new laws going into effect that once someone files bankruptcy, they will no longer receive anything. So in order to keep my business, I was requesting a lower interest rate. Three representatives later they still refused due to their computer and they said they ran a check and nothing was available for my account. Well, I didn't ask them to check for offers available for my account and I know that there is a way to lower the interest rate, so now they are two account holders short of what they were when I called. It is just frustrating not being able to speak to someone that I can understand and I know cotton picking well that they can lower the rates as they please.

I have been looking for a class action suit against Capital One for a long time. The first time I searched for one was 2004. I paid capital one 9.99 a month extra on my credit cards for payment protection for years. This was supposed to cover me in the event that I went unemployed. The agreement was that Capital One takes over the minimum payments during this time period so my credit rating would be in tact. I also paid $1800.00 into a security funds account. This was to increase my credit limit on the cards. In the event that I ever closed my accounts with Capital One, they promised that the $1800.00 of my money in the security funds account would be returned to me.
When I fell into hardship and became unemployed, Capital One did not honor their end of the deal. They kept sending me all sorts of paperwork to fill out and requests for different items like letters from employers, etc. They promised that once I had the papers in tact, the account would be retro-actively credited back to the very first day that I went unemployed. (I also made various payments in that time frame even though I could not afford it to try to stop the charges they kept adding on to my bill. They pushed me over the limit with their charges and started adding both a $29 over the limit fee AND a $29 late charge). All the while I had called them constantly trying to rectify the situation. I filled out that paperwork three times because they kept pretending they did not have it.
Eventually, all my other bills started to suffer. After about thirty phone calls and months upon months of stress, I refused to pay them due to principal.I was unemployed and they promised me protection; protection that never came. So they stole my $1800.00 of security funds money to use however they saw fit, and completely ruined my credit. No one had a suit going back then and I was so upset and frustrated that I gave up. Things went downhill. Periodically I tried again to come to an agreement with them but to no avail. Now, they just started garnishing my wages sometime in late fall 2009. Can anyone help me? This is wrong and they shouldn't get away with their criminal acts and violations. I can't get a car loan or another credit card or anything.
My credit got destroyed, my wages are being garnished (probably illegally). I have endured years of stress and upsetment over this. It has impacted my ability to move forward with a new credit card, to purchase a decent car, and so on. I did everything they asked me to. I paid and paid and "jumped though hoops" filling out their papers and trying to get them to fulfill their end of the arrangement but they reneged. Their complete and total failure to be an honorable reputable company has resulted in me not even being able to have a checking or savings account without them trying to freeze it and steal more of my money the they already stole. I noticed when I searched this year that there are several class action suits going on involving thousands of people who experienced a similar or exact interaction with these thieves. Help, help. Capital One is doing fraud. From 8.9% interest, it went up to 17.90%. I have never paid late this credit card, and I was paying the minimum. With this new rate on the interest rate, I can't even pay the minimum. Help please. These people from Capital One are trying to take advantage of thousands of Americans. This is completely illegal.
They said they sent a letter in the mail about in February 2009, and I had been living in this place for over 2 years and never received such a letter. I called customer service and waited about 45 minutes, and this supposed manager was really rude and did not care about anything. There is not any proof of the letter they sent.
These people want to make money no matter what! This is an abuse. Capital One is doing fraud. I just had a baby girl who was born a couple of weeks ago. With this increase, we are going to suffer, since I've made a monthly budget. I cannot afford the payments for this card with this new interest rate.

I checked my credit report in January and found that someone had my address changed with Capital One. I contacted them and told them that I still reside at the original address and have never moved, so that my address was fraudulently changed. Whoever had this info changed requested new cards on a closed account and got them along with some checks and charged up over $6,000 before Capital One put any restriction on the account.
They negligently changed my address and phone number contact info. Also, they let the charges continue on an account that had been closed for 5 years without ever verifying the changes. I did get copies of all activity and checks written on this account, and the signature on the checks is not my wife's.I sent them a certified letter stating this is fraudulent but have yet to get any response from them.Their customer service reps have been rude and nasty with me and told me that I am basically a liar. All they want is for me to pay for charges that were fraudulently made. They do not care about their customers; all they want is money.

I have had a Capital One credit card for many years. The interest rate has been 4.99% for several years. Today, 2/16/10, I received my statement and interest rate has increased to 15.9% ! I received no notice of this, so immediately called customer service. I was told by the representative that there was a change in terms sent out in early February which increased my rate. I told him I never received it. He said it was too late to opt out of the changes. I then asked to speak with a manager who came on and had the nerve to allege that there was a change in terms sent to me in February 2009! As if!
And that I had had until April 2009 to opt out of changes that were to take effect February 2010! I never ever received this alleged mailing and told him so. He did not care, just said it was too late to opt out. This is absolutely ridiculous and I doubt it's even legal! Are we really to believe that a credit card company will send out a change in terms one year in advance? My rate was not a promotional rate. It was tied to Libor and was 9.9 for a long time before going down to 4.99. I cannot understand how this can be allowed. Does anyone know the regulations regarding these changes? Or who to complain to about what I believe is a gross violation of my rights? thanks

I was charged a $59 "Membership Fee" by Capital One on a credit card with a $550 limit. That's over 10% on any available credit! In the past, I was able to have this fee waived, but today, I was told by customer service that Capital One has decided not to waive these fees in 2010. I used to have a second card (account) from Capital One, and was charged the same fee soon after paying off the card. At that time, they claimed that because I had waited more than 30 days, they could no longer waive the fee, and I had to close the account in order to get the fees waived. This time they gave me a different story; that Capital One has decided to waive any membership fees in 2010. The only consequence to this fee being imposed is that it will take longer to pay off this card and close it than it did the other Capital One CC account I closed earlier in the year. What a rip-off!

On December 21, 2009 I decided to take advantage of a balance transfer offer that Capital One had that stated it would be for my existing purchase rate, which was 3.40% and no fee. The rate I was paying on the other card was 6.99%. I was told by Capital One that the rate was locked in. When I received my next statement from Capital One, the rate is now 9.9%. They told me I was notified a year ago that my rate would change (which I was not). The person I did the balance transfer with also told me it would stay at 3.4%. When I spoke with Capital One today, Melisa (ID number **) offered to give me a $50.00 credit for this false information. Please note: my credit is excellent and I have never been late with any payment, and always have paid much more then the minimum payment. I can not afford to pay off this card which now has a higher rate than the one I transferred from and I currently have no offers to make a transfer.

I have had an account with Capital One for over 5 years with no complaints. In April of 2009, I received a letter from them telling me that in January 2010, the interest would be going from 14.99% to 19.65% plus the prime rate. On page 4 of the pamphlet they sent were instructions how to decline these changes. I had until July 28, 2009 to make my decision. On May 22, 2009, I called and closed my account. According to the pamphlet, I was to pay down my account at the existing terms (14.99%). Also according to the pamphlet, my account would be permanently closed and if I wanted later to continue with Capital One, I would have to fill out a new application for a new card.
On February 9, 2010, I received my January statement. The interest was 22.9%. Checking back through my statements, I found that in September 2009, I was charged $59.00 for a membership fee, which I did not authorize. I called the number on the statement to get the problem straightened out. Each time I called (3 in all), I was connect to someone I could not understand. It was as if I was talking to a double talking Hindu lawyer. As near as I can tell, they told me my account was on suspension to close and was subject to rate increase and I could use my card anytime I wanted to. This was not what was in the pamphlet they sent me and what I agreed to. What can be done to get this matter straightened out?

They sent me the forms and I submitted them with all the required information. 5 months later and after many phone calls, they indicated my request was declined. Despite that, they offered me a 6-month forbearance plan to bring my mortgage payments up to date and review my request for a loan modification after my loan was up to date. Of course, the plan has additional interest, charges and fees which I had to accept due to the circumstances and to avoid losing my home.
I, as millions of Americans, have lost faith in the American banking system as it has proven over and over again to be taking advantage of the American people. They have not helped me solve my situation at all in any way. On the other hand, they suggested I am better off losing my home, maybe so they can re-sell it and get more profit. And finally they told me that a future application for a loan modification would be turned down. Oh, by the way, I have not defaulted on the forbearance plan.

I called Capital One customer service when I noticed a jump in my interest rate. I was told that a letter was sent out in February 2009 giving me the ability to opt-out of this interest rate increase by closing my account or accepting the interest rate increase and keeping my account open. This increase was to take affect in February 2010, because I was such a good customer. The problem being this letter was never received by me in order to opt-out, which is what I ended up doing with my other credit card. Three people told me that my opt-out option had expired, and nobody could change my rate. There was no other option. I asked could they prove that this letter was actually sent? They said it went out first class mail, no tracking number or any other verification was available. Can they actually tell me that my opt-out option expired when they can't even tell me if the letter was actually received?
This doesn't seem fair. It wasn't like I am waiting and let this go months with out calling. I called the day I saw it on my account online. I didn't even receive my paper statement yet. Just because of the economic environment, they have the right to raise rates for no reason? Especially on good customers, see as I stated above they gave me year with my old rate. I tried to continue to talk up the chain, but I finally was told if I needed to escalate my complaint any further, I needed to send a letter, and if I wanted proof if it was received, I should send it certified mail.
I think that the credit cards should have to show proof of delivery in notifications like this or give the customer one month to call in to opt-out. For the entire year not other letter, follow-up or warning was mailed or even stated on my statement. This whole thing seems deceitful. Luckily, unlike some of the other posts, every person I spoke to was pleasant; unfortunately they just couldn't do anything. Can we file a class action lawsuit? We have to be able to do something.

I am writing because I made a payment arrangement with customer service rep, Noah, months ago to bring my balance current. He agreed to do so. All payments have been made timely. In January, I had no funds available and contacted Noah to date a payment a week after (work payday). He rudely refused stating that he went out of his way to make the original arrangement and that I should get a payday advance.
Last year, finances were bad and I had many advances. I am now barred and wish not to apply for more advances. I explained this to Noah and he rudely said it was he who went out of his way to make the arrangements. I explained that Capital One would only have to wait 7 days for payment but he refused to listen. I calmly explained that I want to pay this balance in full, I want to bring my account in good standing and I want to make payment arrangements but he ignored my plea and repeated "Get a payday advance or borrow funds".
I repeated that it was impossible for me. I asked him to work with me. He rudely refused. He transferred me to his supervisor who stated she had been listening to our conversation and that I had not made a good enough effort. She was extremely negative and abusive in her tone with me. I did not appreciate her attitude. I repeated to her that I wanted to pay the full amount but had to make payment arrangements. She refused to listen. "Get an advance and if you're rejected, fax me a letter". I stated that I could not get an advance. She not only interrupted me when I spoke but talked over me.
It is saddening and disheartening that the representatives have such a bad attitude. I really thought I would keep this account open after bringing it up to date (unlike my other Capital One account which I closed). I have now changed my mind and I will close this asap. Funds will not be available and will set me back with charges but the representatives do not care about that. They don't care about the impression they give clients of the company. I am very disappointed. Capital One did not bother to respond with an actual answer.

Last summer, I noticed my increased APR on my credit card after my initial period of 4.9% to 23.15%. After reading some of these other stories, I guess I should be happy with that, but I am not. What happened to the government stepping in to stop these thieves from the ** and pillage? I finally closed my account in October and keep receiving calls telling me to call in for my APR decrease.
When I call, I am told that they cannot do it. Three weeks ago, I was told that if I paid my monthly payment plus an additional $200 then give it 3-5 days to post and then call back, then they would decrease the rate. Today, I called and spoke with someone named Kelly who told me that there was absolutely nothing she could do because I closed my account. That it was frozen until September 9th of 2010 and then my interest rate will drop.
This is absolutely ridiculous. What kind of business is this? I see the "What's in your wallet?" commercial and want to scream that it is not their card! I will be finding a different card to transfer the balance to and never in a million years will I ever recommend this company to anyone I know, nor will I keep my mouth shut about their business dealings. They are thieves and scams. Note to anyone reading this, do not ever subject yourself to this company!

Capital One changed my interest rate as well from 4.9 to 13.9. Funny this increase made my balance go over the credit limit fee which charge was $39.00. I have complained to Capital One but they will not budge, told me to "close my card" and risk my great credit. Congress needs to act now and not only cap the rates in June of 10 but make them retroactive to what Capital One is doing now to their customers. Pure loan sharking at its best.

A letter dated Jan 25, 10 was mailed to me, Joseph, regarding temporary restriction on my credit card account. It stated that a return payment was posted to my account and to reinstate this, a valid payment must be made asap. My wife, Dawn, called our bank and talked with customer service and asked about this check and if it was it returned. After checking for several minutes and even verifying that at that time we had an average balance of $800, they could not understand what happened, nothing was returned.
I called Capital One and gave my wife permission to discuss this letter since she pays the bills and was told by the girl who answered that our account had been closed and we wrote a bad check. After explaining things and what our bank had said, she insisted we had wrote a check on an account closed. My wife then asked for a supervisor Val (sounded like last name **). He transferred me from one department to another and kept going over the routing numbers several times; we gave our branch number of First Bank and had the manager Mila get on a three-way call and confirm that our account was never closed and she had no idea what they were talking about.
Finally after all of this and a couple hours of wasted time, Val finally said okay I have located your check on my screen and see that you wrote it on 1-13-10 in the amount of $15 and it shows that your account was closed. My wife then asked for a copy of the front and back of the check and asked it to be faxed to us. It came over the fax with Attn: Dawn ** Copy of check to Capital One returned - closed account - Capital One (FAST) all written by hand. No phone number or fax to call back on the cover sheet.
We took it over to the bank and showed it to them and it was meaningless; it only showed the date it was deposited ,1-14-10. Capital One acct#0514XXXXX. In the meantime, our bank sent a letter to this address on First Bank's letterhead stating that this was never returned or closed. Val had said he would call around Tuesday and follow up and he never called. Now, they want a cashier's check or money order for $15, $39 return check, $29 past due. Important info we brought up to Capital One, we have two other Capital One accounts that were paid after this check, within a week that cleared with the same checking account.They could not give us an answer as to how these checks cleared?! This is very stressful.

I was getting a car loan and the dealership went through Capital One. They told the dealer I was approved so the dealer sent me home with the car. The next day I got a call from the dealer saying that they needed proof of residence. So I faxed a copy of my light bill. The next day then, Capital One said that was not good enough so I sent a copy of my house insurance. That was not good enough, too. So I sent them a copy of my bank statement and again, that was not good enough.
Then I sent them a copy of my car insurance and a copy of my car registration and my vote registration card and a note from the county that I live in so they said it was okay. Then 4 days later, they called me and said that they needed to get proof of residence still

My dad got this card in 08 and the balance was 950 and the rate was like 3.0% and he was paying 15 a month then in June, I made a payment for him over the phone and they said make a payment of 20 which was not the payment. Then, they said the rate went up and I was never told about the change, so as I continued to make the 15, they were not taking it. Making me have late fees over the limit and the balance grew to now 1400 and I wrote them emailed them and no one has seemed to help.
My dad has memory and poor health and these people didn't even care, said I had to get a power of attorney and my dad sign well in his condition. He can't so, what do I do? I don't need them to send him court papers. I said to lower the balance to where it was before and I can make 25 payments but they wont budge what can I do or who can help me because they seem to not care at all.

My credit card account with Capital had a balance of $1,200 when it was placed in a hardship in the end of 2008 because I became ill and subsequently unemployed. Since that time, because I missed payment in July 2009, interest and penalties incurred to the amount of $1,400 and was turned over to Alliance Collection. From there, it went to the law firm listed with more interest and penalties.
I am willing to pay the $1,200 but do I have to pay the additional fees totaling to $1,700? I was working part-time until I became ill with conjunctive heart failure and now receiving monthly income. I did attempt to pay and contact Capital One via the internet and continuously forwarded to Alliance and as time escalated so does the balance on the account. Please advise.

I was trying to sign up on paying my credit card bill online and I clicked on it. After filling it out, I hit enter and I am signed up to a credit report company for a 7-day free trial. I don’t want that! I was just trying to set up paying my bills online and now I am messed up with this credit report company. As big as their company is, why can't they make things simple for people to pay online like all other companies? I am a very angry customer. Now I have to mess around and call to get this thing cancelled.

Prior to December 2008, Capital One called in regards to payment, however, they did not make my payment protection available to me by sending me the claim forms or making information available. In December 2008, I wrote Capital One and had asked them to only send correspondence in regard to collection that I was extremely ill, I had promised that I would pay the account off as soon as I got my disability. On March 2, 2009, I would write them again regarding the collection calls.
The damages would be credit report score due to not being able to use payment protection, harassing collection calls even after writing and requesting I have correspondence sent to me. The letter I sent in Dec. 2008 included doctor statements that I could not work. In March 2009, one of their collectors told me I was not ill. I also have records of times that they would call after collection hours or before.

I contacted Capital One in December of 2009, after I received their "opt out" letter, because I was 5 days delinquent on a payment. After 5 years of being a valued customer, they felt the need to increase my rate from 9.9% to 24.0%. According to the letter, I had the right to close my account and decline the terms of this letter, which I did to avoid a 13% rate increase done.
Today, I received my statement (in the mail) which I have always received online statements/messages/alerts with Capital One, with a new percentage rate of 17.9%. I called Capital One and informed them I opted out of this, closed my account and my original terms shall remain in effect until my balance is paid in full on or before 5 years from now, assuming I have no late payments, according to Credit Card Reform Act of 2009. The "account manager" informed me I only replied to the "Stage 3" letter so Capital One assumed I agreed to "Stages 1 and 2" letters so my rate therefore increased.
As I am talking to the very rude "account managers," Melanie and Oscar, they just keep repeating the information about the ridiculous letters and do not have any answers. Why, after 5 years of always getting online statements/messages/alerts, weren't these "stage letters" part of my online documents? Maybe so they can use the United States Post Office as a scapegoat for their deceitful actions.
Something has to be done about this. I called, opted out, so because I only called once to the 3rd Stage letter and not the 1st or 2nd (which I never received), I am still prone to the 8% rate increase? Why didn't they mention anything about this when I called on the "stage 3" letter? This is just sickening and gut wrenching that Capital One, to whom was handed a ton of bailout cash, can do this to their own consumers. Who do they think is going to pay back their bailout funds? Us (consumers) and we don't have a choice in this matter but they can continually rip us off and ruin our credit if we do not abide their terms/conditions.
Why do they get to bend and disobey the Credit Card Reform Act of 2009? Just wondering Capital One, did your employees get training on how to be so cold and heartless to their consumers? I am now going to have to pay 17.9% interest on a $7,700 credit card balance, which paying what I am paying now as a monthly payment and as a single mother of two is all I can afford only to be paying Capital One the interest on this account! All I want to do is get this account paid off and put behind me, but at this rate and these economic times in Michigan where no wage increase is expected in the near future, I am pretty much out of luck! I have a Capital One account. The company had reduced my credit limit from 750 to 500. I am now being assessed an over-limit fee on my monthly bill. I can not seem to be able to resolve this issue with the customer account representatives and have been sent to "speak with my supervisor" and get nothing but dead air and I have to redial and go through the entire procedure again. Does anyone know if I report this to the three "credit sisters", I'll be able to get any resolution? Help!

I needed some cash for an emergency. I contacted Capital 1 for a payment extension they refused. I have never requested an extension before. I have never had even one late payment in 4 and a half years. I only owe 3 more payments and they would not process my request for a deferment. Some guys from India said "the system won't allow it" so much for their helpful, personal service. They've lost this customer, for life!

In January 2009, I had a problem with a payment of $852 not being applied to my account. My bank confirmed the payment was issued to Capital One. It took 4 months of calls and faxes for Capital One to clear up the problem on their end. Did they notify the credit score companies it was their error? Of course not!
Then I had to fight to get the late fees removed! In October 2009, I closed 2 cards I had with them because of the new fees. It took 2 weeks of calls to get them both closed. Lo and behold, today, I get a bill on one of the accounts for membership and late fees! 2 hours of being on the phone later, they said both accounts are now finally closed. Time will only tell!

Capital One has illegally penalized my account for erroneous charges even after it resolved the issue. I was erroneously charged by a company who contacted Capital One and reversed the charges. Two months later, the same company re-charged my account through an unknown dispute, which I had no knowledge of. Capital One then re-charged my account pushing my account over the limit and then sent me forms to refute the charges. In the meantime, Capital One continues to reap over-the-limit charges.
This is a terrible company and I have spoken to them several times about erroneous charges. Capital One only posts its yearly fee when the account is low as to push the account over-the-limit and reap the penalty fee. I am closing my account with Capital One and will pursue this issue until all consumers are safe from fraudulent activity like this. In these economic times, financial institutions are attacking its consumers with fraudulent behavior and fees. As a member of a consumer group, I will not be bullied by Capital One and look to pursue this matter till the end. I have been charged over $500 in penalties in the last 2 years and my credit rating has plummeted resulting in personal and professional damage.

This credit card (Capital One) bank continues to mark my account "designated to close" when I called months ago and asked them to close the account. They even sent me a new card which I have destroyed. They continue to raise my interest rate and continue to raise the amount of my debt on cash advances every month even though I have not used the card since summer of 2009. I called today and asked them to close the account. They told me that they will not close it until the balance is zero.
The other credit accounts I closed in 2009, all froze the interest rate at the time I closed them. Why is Capital One allowed to raise rates on a closed account? It just doesn't seem fair to me. The rate is 21.44% which is very high on the cash balance, and my payments are applied to the purchases and very little is applied to the cash advance balance. So every month in spite of not using the card, the cash advance balance goes up. This cannot be legal or if it is legal this unfair practice should be stopped.

I only use this card when I go on vacation, so my attention to checking balances online only happens when I get back from a trip. I have had this card for about 8 years and have never had an issue. In November, I received a new card in the mail and was required to call to activate the new card. The customer service rep offered me a free special for a credit inform service offered by Capital One. Being the intelligent consumer that I am, I knew there had to be a catch and declined the offer over the phone. I was very clear in saying no.
In January, I receive a notice in the mail that I am past due and owe close to $50 on the account I had not used since August. I called Capital One to have the problem resolved. Nope. I had to call Credit Inform to be credited back first. I waited 5 business days, and I called Capital One again. Okay, fine. They reversed the late fees but not the finance charge.
Now, I have to wait another few days and then call another department to have this cleared up. I never signed up in the first place. I am afraid this will lower my credit score, and I have wasted time and energy getting this righted. It is ridiculous that Capital One is the one who signed me up, yet I am on phone call number 4.

I have had my credit card for over 10 years. I have always paid, but have had low limits. In 2005, I maxed out my limit of 1300 and have been paying it off since only to get nowhere. I have been unemployed in the last 1 and 1/2 years and could not pay in 9/09, and 10/09. It has been sent to a collections agency and I now owe $1600. I do not have the means to pay this and I am being threatened with legal action by the collections agency when I have tried to tell them all I owe is $500. Capitol One will not respond.

I was on payment protection from 2002-2007. Capital One was receiving payments from me when claim payment wasn't accepted before due date. Capital One was requested to close my 2 accounts. So I thought then I received bill with renew membership. I hadn't received new cards. I call and was told I still had a balance account and it would be closed. Without knowing, they didn't remove membership fee. It created late fees then over limit fee. I didn't know it was there and I was not receiving any bill. I was unable speak with someone on the phone.
So I emailed corporate and they send me statements that I never received before September 2008, even 6 months late payment. I have been in the same address for over 10 years. I was told mail request was my only communication with Capital One. I was told they sold my account in 2006, it's not their problem. So I asked payment protection and paid $657.04. I will contact the collection on my credit file and settle in dispute! I was told I could call that they wouldn't call that money is all Capital One. So I called and was told that I still have to pay and this will stay on credit until I do.

I had lost 3 jobs in the past 2 years, due to the economy. One job, is the one I have had for 16 years. We have been a Capital One card holder for years, and we were great customers. Times were hard, so we called them, and explained to them what was going on. They said that they would work with us. They did for 3 months. Now, we owe $5,000, and they told us that since we have not made full payments, that they are charging off our bill, and that they want payment in full or garnishment of wages, or a lien on our home. Now, they are still taking $180 a month out of our checking account for payment. How can they do this to us? These people are the most unprofessional people that I have ever dealt with. What do we do? I have been losing sleep because of worry.

A toothpaste fraudulently billed me twice. Immediately, I started disputing the charges. I sent all the required documentation. One minute, the dispute department claims my account has been credited; the next they claim they never received my evidence; then the next time they claim it’s all taken care of. The whole process was supposed to be 45 days, which is has been. And now because of their constant mistakes, they inform me I have to wait another 30 days. I tried to close my account and they wouldn't close the account.
I can't understand half the words the employees are saying because their accents are so thick. I tried calling customer service for assistance, and I received no help. I tried to get help online and they just kept referring back to the dispute department and investigative solutions. I am being fraudulently charged and I can not get any assistance from the company that is supposed to be protecting me.

I recently requested a replacement credit card from Capital One because the one I had was worn out. They sent me a new one. I emailed them and told them that I had received my new card and what do I have to do to activate it. They emailed me back and told me the card was already active.
They sent me an active card through the mail. This is not good practice.

I tried to work out payments and they would not take it. And then another time, they keep asking for more proof of residence after I had sent them 4 proofs, and still not happy all because our county put in a new 911 address.

I got the Capital One card as a promotion to rebuild after BK in 2005. At that time the interest rate was 11.9%. I used the card for five solid years, paid as agreed, never over the limit and never late. I also got a shock and awe campaign. I asked them for an increase as in five years they never once granted me one. Upon reading my contract, it clearly states we are to have our accounts reviewed periodically or every four months. That means I have had no review and due 20 periodic reviews. I emailed them and asked them to increase my line credit from the set 1500.
They refused and said we cannot request an increase as it is performed by corporate during their periodic reviews. I then demanded a manager and explained to him I had been passed up for 20 periodic reviews and how could this happen. He referred me to customer service which can do nothing for the consumer but give you account info and take a payment. I then wrote Capital One 37 times about it in six months.
Not one reply. I maxed out the card and then demanded they grant me my due increase and reduction in my interest as I sure did not deserve any increase as I have never been late, over the limit etc. They would not budge. I then just let it go. If they come after me for it. Two more years file BK again just on them.

I have not been receiving my monthly bills. I checked my credit report to see that they have been charging me monthly, but not sending me a bill. It went from $400.00, the original charge I made, to over $1,000. Each month they keep charging me without sending me a bill. Not to mention the late fees are adding up as well. I have not received any billing statements from this company, yet they are putting this on my credit report. I have tried to contact them, but to no avail. I am disabled and am dying from NHL Lymphoma cancer.
I am under constant doctors care. I am on a fixed income of $600.00 a month. I am not able to pay this amount that Capitol One keeps charging each month. I have not received a bill from them. This has caused Post Traumatic Stress Disorder, along with panic and heightened anxiety attacks. Not to mention high blood pressure from worrying. I do not have the finances to pay all the amount they are charging. I am a senior citizen and do not need this hanging over my head.

I have 5 accounts with Capital One. I was paying online monthly only to find a couple of things occurred; 1) the money left my bank, but was not applied to my credit card until after the due date, 2) the company arbitrarily charged the monthly and/or annual fee which invariably caused over limit fees and late fees because the new over-limit made it appear as though payment was not made and 3) spiraled into raising my interest rated on all fees, thereby tripling my monthly payment and the cycle continues. Additionally, the company failed to properly notify me through the online banking choices I made to have notification received in proper amount of time and not sent to spam folder.
I have lost the benefit of the bargain. These are contracts of adhesion, which has threatened by ability to raise capital for my law practice and I have paid an enormous amount of money. Capital One has sketchy employees who do not properly credit accounts, document phone calls and actually sell private financial information to harass and abuse their position and power. These are organized criminals who work with financial institutions to divert money, not on the consumer level, but on the system level. Where is the FBI?

I had two cards with Capital One, one personal and one Corporate. When I moved, I submitted the change of address online. However, their system never updated this information and continued sending the bills to the old address. At the same time, I attempted to set up auto pay for this account and was told I would need to send out paperwork and they would send it to me. I never received the paperwork.
As far as the Corporate account, the same occurred when I submitted a change of address online, no bills arrived. Finally, after about two months, the post office delivered the bill and it was two months late. Since this account runs through an accounting department, I did not have any knowledge of this. However, when my accountant called them to change the address, a completely inaccurate address was submitted to the account.
Both of these accounts had to be closed because the liability of having a Capital One account is much too high due to their complete lack of efficiency and/or online services. If you are considering getting a Capital One account, I must warn you, it seems that they are looking to make a mess out of your credit. My credit score dropped and created much difficulty with other good credit accounts that I hold.

I fell behind in my payments to Capital One at the end of 2008 beginning of 2009. I explained to them that I would not be able to catch up until I receive my tax refund. When I got my tax refund, I contacted Capital One and the rep told me that I had two choices. First, I could close the account and they would wave the late fees and over the limit fees (I was only over the limit due to their fees) or secondly, I could pay the fees and bring the account current. I chose to pay the $1300.00 to bring the account current. Capital One cashed the check for $1300.00 and closed the account. I was attempting to refinance my mortgage and due to the closure of the account, my credit was adversely affected making it impossible to refinance. Then, my wife lost her job making it impossible to make the payments.
I contacted Capital One and explained the situation. I told them that I would pay the account off when I got my 2009 tax refund. Having dealt with them in the past, I also sent a registered letter explaining the situation which I have receipt to prove that Capital One received it. Capital One reps contacted my father-in-law in an assisted living center and questioned him about the account, my wife and my status. My father-in-law has nothing to do with my Capital One accounts. They also contacted my sister-in-law with the same questions and she too has nothing to do with my Capital One accounts. I am not trying to hide from their calls and do not understand these attempts to collect money from people not involved other than to harass and embarrass me in front of family members.
My father-in-law had a panic attack due to their contact. I have read the Fair Debt Collection Practices Act and I can prove that Capital One has intentionally broken several provisions within the act. If they have done this to me, this must be their accepted practices. What legal recourse do I have to stop them and/or sue them for illegal practices? How did Capital One get the phone numbers of family members who having nothing to do with my accounts? I was unable to refinance my mortgage. Capital One has harassed family members who have nothing to do with my accounts. Capital One has contacted me at work using fictitious names

I had arranged for a payment plan with Capital One. Three payments of an amount that I do not remember at this time. I paid the first two and on the third one, I called them a day late. They would not budge and said sorry, they couldn't help me. My original limit was $500 and now they are trying to get almost $1500 out of me. Not going to happen.
They could not even show a good faith gesture as I had made the first two payments on time. Now they want three times the amount? They are insane if they think they will get that from me. I should have never opened that account after the numerous complaints about them. I'm seriously considering taking them to court. I am now in collections for an absurd amount. Should I need to purchase a new car (mine is almost 10 years old), it will be very difficult.

I have had two accounts with Capital One for several years. One, I paid in full. The second, I was paying on a monthly basis. There was occasionally a charge on my statement listed as Membership Fee of 59.00 and some other monthly fee of $6.00. I contacted Capital One by letter along with my payment and told them that I was no longer using the card, that it was destroyed.
I was simply trying to pay off the balance due on the account and would like to be removed from membership dues and monthly membership fees. I was told that if I canceled my membership, the entire amount due would be demanded in full. After that, the last statement I received from them was approximately Nov or Dec 2008. I sent them emails, I sent them letters, I sent money to a payment center without a statement. They called me in April and demanded payment. I told them I would catch up the account, but I wanted a statement to show my payments and balances.
The woman from India or somewhere, after almost an hour, finally got it through her head what I was trying to do. She was asking for bank account info and such so that I could be set up automatically. I told her that that was not what we were doing, but one time payment only and monthly statements. I never received a statement.
I contacted them in July to find out when I would get statements. I then sent money to a payment center that they told me. I told them then, that if I did not get a statement, I would not pay a bill for something that I didn't know what I was paying it for. I have not charged to this card in over three years now.I have yet to receive a statement but I am now in January 2010 getting calls from a collection agency wanting to set me up on automatic payments. I am very hesitant to make any arrangements with this company after reading all the reviews online.
Please help. This is very stressful to me and my family. My husband is a very sick man, and we are not able to pay off in full because of limited income. He is disabled and I work minimal income. I am supposed to contact them today to discuss again. I don't care about paying them something, but I feel like they have cheated me for years by adding fees and dues to this account. I can never pay it off because the amount changes with interest and penalties every month.

My husband was issued a new credit card by Capital One approximately five months ago. No interest for one year! On January 8th, he went to use the card to gas up and use the quick pay. The card would not authorize the purchase. When he spoke to one of the customer service reps, they said that it was because we had not paid anything on the card by the December 22nd due date. I went back through my records and noted that I had sent a check to Capital One on the 12th of December. We then checked with the bank asking if the check had cleared. They stated it had not. We figured, "Okay, it did get lost in the mail." On the 19th of January, I attended a meeting relating to work and one of my co-workers stated how the same thing happened to her at about the same time frame. I questioned if the checks were actually lost or if they are sitting in a room in order to show that "late" status because of the new regs that are coming into play.

For over three years, I have made monthly payments to Capital One using electronic payments from my bank. Paid at the beginning of the month (between 5th-9th). My due dates were usually at the end of the month (between 26th-29th). The billing cycle was also at the end of the previous month (between 27th-26th). Suddenly, without notice, my billing cycle changed from 31 days to 39 days cycle causing end of cycle to be at the beginning of month instead of the end. When my monthly payment was received Dec 4th, it was applied to the previous month because the money arrived on the last day of my new billing cycle.
Therefore, payment for December was not given any credit. November receive two payments. I received a statement that no payment was received for December with late fee of $39 and a statement for double payment for Dec and Jan $179. I am appalled as all representatives stated how sorry they are, but can do nothing but waive the late fee. Supervisor Chris stated that they were regulated by the government to change billing cycles. Contrary to his statement, the other supervisor Frank stated that the billing cycles never change.
At the beginning of the year, my interest rate was 9.90% then in June went up to 17.90%. I was doubling my minimum payment at that time. I have paid January's payment of $100 on the 5th of Jan. which is more than minimum payment. But because of the change in billing cycle, I am required to pay an additional payment of $40 due on Jan 29th. If I do not pay this second Jan payment, I will be charged a late fee of $39. I feel very insecure with this company now. I have lost faith not knowing what scheme they will come up with next. What happened to business ethics?

Capital One is not applying extra payments to the principal but instead, applying extra payments to the next payment due. Interest that has not accrued is being paid in advance. The 1st contact, 1/23/09, I specifically questioned the method and told Capital One that the extra payment was to be applied to the principal. No action was taken and I was told that I was wrong that there was no prepayment of interest. The 2nd contact, 01/03/10, I questioned the situation about the fact that any extra payment is applied toward the next payment. The answer I received was the same answer. The 3rd contact, 1/18/10, I called and e-mailed. On the phone I was told "it is not a prepayment of interest and that there is nothing illegal about how the payments are being applied toward future payments."
The last response from Capital One in writing states I should call customer service to designate an overpayment to the principal, which clearly admits that overpayments are not being applied towards the principal. The FAQ's on their website also clearly state they are applying overpayments to the next payment due. I only read the FAQ's after I discovered the issue since my contract specifically states no prepayment penalties and payments will be applied to interest accrued and then to anything else on the account, which in my case is strictly the principal.
There is zero information on any payment page stating overpayments to principal must be designated to the principal, no information on how to designate overpayments to principal, and the contract I signed specifically states payments will be applied to interest accrued and then to anything else on the account, which in my case is strictly the principal. The contract, the correspondence, etc. have been scanned and can be e-mailed or faxed anytime. I am paying interest in advance, and the principal balance is not being reduced by extra payments.

Since 2007, I have tried several times by phone and by mail to close my Capitol One credit card account. I have a zero balance and owe them nothing. But Capital One has not closed it. Earlier today, I called four separate times. The various "customer service reps" make me provide the same information over and over, then tell me they cannot close the account and that I have to wait on hold until a senior rep can pick up. After waiting 20 minutes to 40 minutes each time, or until the Capital One system clicks off my call, nobody ever picks up.
I think that you need to investigate them. Instead of respecting my request to cancel my account in the past, they send "convenience checks" that anyone, including people who take mail from mail boxes, can use. No ID required. I tear them up, but Capital One is just trying to encourage charges, refusing to cancel my account and acting illegally and fraudulently. I checked their rules and regulations, which states that accounts can be closed by mail and by phone, both of which I've tried repeatedly. Please investigate them.

I have worked very hard to obtain good credit and have an unblemished credit report. However, Capital One is trying to destroy this by raising my APR for no reason. I currently pay under 5% and they are planning to use legal theft to increase my rate to 16% APR, which is basically 3 times what I pay now. I have been a customer of theirs for 10 years. I do not charge anything to this card and have been paying the debt down for the past 2-3 years. I recently transferred a balance to this card, which increased the amount owed from approximately $3000 to $8500.
I received a bill from them this month with a notation that "my promotional rate" was going to expire soon. What promotional rate? I was assured at the time of the balance transfer, that the APR would remain the same. In addition, Capital One claims that they sent me a disclosure last February stating that they were going to increase my APR unless I closed the account, in which case, the APR would remain the same. When I called to transfer the balance, no mention of this was made. I never received notice for them.
I have spent several hours on the phone with them over the past week, going from one representative to another, each one telling me they can't do anything about it. It's not a case of "can't"; it's a case of "won't". The last person I spoke with claimed that he was sending an email requesting an appeal to the corporate office on my behalf and a senior account manager would be contacting me either that evening or the next at 8:30 pm to discuss this with me. No one called. I called them back yesterday, Friday 1/15/10, to find out why I did not get a return phone call. The rep I spoke to said there was no such thing as an appeal, that she was a senior account manager and that nobody from the corporate office would be contacting me.
I again stated that they have no right to increase my APR for the pure thrill of it and that they are going to ruin me financially. I told her that this will make my APR amount cost as much as my normal payment amount (I normally pay the minimum plus finance charge and send a little extra if I can) and that I cannot afford to support Capital One's desire to get rich quick. The rep claimed that due to the "financial difficulties" of the economy, they have suffered and had to make this "business decision".
I was completely disgusted with yet another phone call to get nowhere. I told her that they are making me choose between a roof over my head and food in my children's mouths or pay them and guess who the winner will be. She was rude and completely callous and did not care one bit. I think it is completely unbelievable that legal theft is acceptable when the American family is already suffering tremendously between record breaking unemployment rates, not to mention when gas was $4 a gallon and parents were having to choose between a tank of gas or food.
How can this be permissible? Congress is allowing changes to begin in February 2010 to supposedly "help" the credit card situation; yet in the meantime, the credit card companies are "allowed" to put their good paying customers into vulnerable situations in which their families and good credit suffer. Despite my insistence that I did not receive their disclosure, the rep at Capital One said, "It doesn't matter, we are raising your rate anyway." Please help! This is affecting millions of innocent, good paying consumers. Even after asking the representatives to look at my account history and see that I do not even use the card, still this is of no consequence to them and they don't care. Legal theft should not be legal! I am going to have my credit ruined due to legal theft from Capital One. I am a good customer with excellent credit.

I wanted to write regarding poor customer service I recently received while trying to cancel my card. I was left on hold for 15 minutes because only one person is able to cancel cards. Once she finally agreed to cancel my card I asked if I could be given a confirmation number for the cancellation or at least an email confirming it. I asked again because I wanted to be clear about it, and couldn't believe they couldn't send instant confirmation. She was somewhat rude and informed me that I would only receive a written notice.
Capital One should provide an instant confirmation number and email confirmation for all account activities. Every other company does it for things as simple as payment receipts. Waiting a week for a piece of mail is just silly in 2010. This makes me glad I've cancelled my account with a company that can't even be bothered to give a timely confirmation. They have horrible service right until the end. Stick with AmEx! Even their free card is amazing.

On December 16th, 2009 my checking account number was compromised. After reporting this I was informed that my account was put on a "credits only" status. On December 20th, 20009 another check was passed on my account. I again reported this and asked why when my account was put on "credits only" there was a check allowed to pass. I was told that the bank assistant manager had been on vacation and had not placed my account on "credit only" as promised. Further, I would now have to file another fraud affidavit and wait on my funds to be returned.
When I asked what Capital One does to recover the funds, I was told that they really did not pursue this. Since Capital One chooses not to pursue so did I. I was then contacted by the bank and told that since I didn't want to pursue with the local authorities, they would not return my funds. I returned to the bank and asked why I would not receive my funds when obviously this was a bank error to allow the check to pass in the first place. After dancing around the fact I had to go back to the police department and get a case number in order for the bank to return the funds. At no time did any representative at the bank admit to the fact that they dropped the ball. What terrible customer service and accountability. Now, "What's in my wallet?” Not Capital One. "No hassles," I don't think so. I waited 22 days for the money to be returned over the Christmas holiday when cash matters.

I have two Capital One cards. The one I received a notice back in June my 9.99% interest was going up on Aug 1, 2009 because of financial economy. Garbage of course. Then my other card which charges slightly in the 8% range I hadn't used for 7 months after paying off a promotional offer of 1.99. After receiving the notice on the first card, I wondered why I didn't get a notice on the other account. I called Capital One around July or Aug 2009 and the guy assured me this other card wasn't changing.
So in Nov and Dec, I finally used this card at my 8.33%. At the end of Dec, my daughter said I better call to verify as every credit card company was raising everyone. Behold to my surprise, the range of different people kept telling me my interest indeed is going up in Feb2010 to 17.1%. I never received one notice all year on this account. They kept saying the offer. I never accepted any offer since the one I paid off from 2007.
They are crooked, deceptive, fraudulent and whatever I can think of. I have been fighting with them for at least two weeks now because they keep telling me this offer was sent to me either in Feb or May of 2009. Funny, they didn't know which month. They are trying to tell me they sent this to me a year ago. They are deceitful and total crooks and greedy. I kept telling them they have never sent me a 45 day notice. They guy said the bill hasn't taken effect yet. Everyone else I talk to have received notice between 3 weeks and 45 days ahead and the excuse is they only have to notify you 45 days in advance. We all need to either stop paying all the credit card companies and let them eat it or file bankruptcy.
Anyone out there want to get a class action lawsuit going, I'm ready as I'm totally fed up with all these credit card companies and very stressed out. This last guy I talked to told me a different story that they sent me notices in Feb and May 2009. This was a new one. Also since my call, they have not put on my ATM which I got online as I haven't received it in the mail yet, that my promotional rate will expire soon, as of 11/25/09 , which a new one now. Also on the bill, they talked about the new credit card act of 2009 and have this on the statement. No notice of 45 days is being given here and Capital One doesn't think they have to give the 45 days notice because it's not Feb yet. But they are raising it in Feb. Help!
Obama has screwed all the consumers and gave free field to the credit card companies to raise the interest as high as they like as long as they give you 45 days notice and some are not giving you the notice. They are just raising the interest. Anybody out there with the same problem? I did see a few of you. Let's get a class action going as soon as possible.

I have been receiving calls from Capital One wanting to tell me about the new credit card laws. They would call and call. Finally, I sat and listened to them and they told me that I had to agree to keep my card rights the way they were or that I would lose all my current benefits. I am not sure what benefits they were talking about. And I am now wondering if I gave up my rights to the new laws that went into effect because of this phone call. Is this a way for the credit card companies to get around the new laws? I don't want to have given up my rights to the new legislation that just went into effect because the credit card company has found a way to get around it. Please advise me of what I should do.

On May 20 2009, I received a letter from Capital One bank after many calls of credit debt harassment calls on debt I was disputing because of a scam. In the letter I received, these words were put:

You'll be connected to one of our customer assistance specialists who can help you avoid additional late fees. Use it to buy gas, groceries or a gift for yourself, whatever you prefer. It's your money. Call to activate your gift card by June 11, 2009. Please keep the code below and call 1-800- to activate your gift card today. We are available Monday-Friday 7am-11pm, and Saturday & Sunday 8am-5pm."
Yes, I still have a copy of this letter. Yes, they were contacted the day the letter was received. Yes I have filed a complaint earlier 2009 on this matter with the FTC on harassment calls and with other agencies on this matter. I feel I was mislead on the $50.00 gift too of which I never got. All I got out of the matter was more stress and continuance of harassment calls. It even seemed to sound like it was calls from the same person I talked with the voice sounded; the same in constant calls coming in at different times of each day. Even at times that were at after 10pm my time. Or even on Sundays they would not seem to let up. Same person calling, same voice, even with a rude tone in their voice. I kept telling them to stop. I feel like I had even sent a letter to them on this matter to stop calling me. Hope you can help me resolve this.

Capital One has been charging me with overdraft charges as a direct result of incorrect information on their part due to a lack of internet access and incorrect account balance from their Telebank 24 telephone line. As a result, the bank has been charging me with (snowballing) overdraft charges that have cost me most of and/or my entire paychecks. They refuse to forgive any charges that are not the fault of the bank. My company said that when I receive my check stub by email, that the funds have been transferred to my account. The bank said I do not have access to the funds until they are "posted". It seems to me that if the bank has the funds in their possession, then they aren't out anything and I should have access to them.
I was told the bank is not at fault for my inability to access my account online with Internet Explorer version 8 or 9 (which have been out for a long time) nor that the telephone service they provide to access my account gives me the incorrect current balance. They did, however, said the reason an ATM can give the correct balance is because they are "in the system". Apparently, my bank account with them does not afford me the same privilege. They refuse to forgive overdraft charges ($35.00/per) or come to any type of arrangement to avoid these charges in the future. Most of the overdraft charges were for amounts under $35.00 which translates into 100%+ interest referred to as a "service charge" (usury). I make an automatic deposit on a weekly basis so it is quite obvious I am not a credit risk, yet I do not qualify for any credit.

In 2006, I received an offer to get a credit card. I was homeless at the time, but working for a company I used to work for in the late 90's through the early 2000's. They did billboard advertizing, and I spent months on the road in different cities all around the U.S.A.!
Anyway, I put down my salary plus what I received in retirement benefits and was informed I will be getting the credit card with Capital One. So I charged small amounts for mainly gas for my car, and much needed food i.e. sandwiches. After 2007 through 2008, I just paid the minimum they asked for on each statement. In February 2008, they raised the credit from $500.00 up to $750.00, I still paid the minimum. In the halfway mark between 2008 and 2009, they started charging me late fees and over the limit fees.
So before I knew it, I was paying through my cell phone directly to Capital One on the net between, $100.00 a month up to $200.00 a month. I haven't made any purchases in over 8 months and each month they are still adding the late fees and over limit fees. My statement date is the 29th of each month and I've been paying through my Visa card at my bank where my Social security benefits are being directly deposited and sending in the payment by the 6th or the 10th of each. How can I make a complaint to the Attorney General's office, and how can I file a class action suit against Capital One?

I've been trying to make purchases on my credit card with Capital One for two days now and they have my credit card locked out for no reason at all! I can't make any purchases. For example, I was trying to make a purchase in Sweden and my card was refused like a common criminal! How embarrassing! I've paid Capital One faithfully each month and have no late payments on my record and they treat me like this!
It all started when one time, an inverted two numbers on my credit card and I corrected it immediately! They have locked me out for two days without asking my courtesy a question one time! What happens now is my credit record ruined forever?

After reading the complaints about Capital One, I realize I am far from alone in dealing with their deceptive practices. While many people didn't receive the letter about the increase in interest rates back in early summer, I actually did, although little good it did me. It stated that my current rate was being changed to a "promotional rate". It then went on to say that "Beginning January 2010, my Purchase rate would increase to 17.9%". "Please note that this rate does not affect any special transfer, introductory or promotional rates unless or until they expire". Never did it say anywhere in the document that my new "promotional rate" would expire at any time. I figured possibly new purchases may be affected, but I wasn't worried about that as I had stopped using the card for purchases and was trying to pay down the balance.
As I pulled up my January statement online, in very small print it noted, “As previously disclosed, your promotional rate will expire soon. . .equal to 17.9%." I called immediately and was assured by the customer service rep that I was fine and that the increase did not apply to me. As my statement said differently, I asked to speak with a supervisor just to make sure. She had a different story and "found" a copy of the letter that was sent to me. It wasn't even the same letter I had received!
When I explained my confusion about the promotional rate, etc., she had no response. I asked to "opt out" as I couldn't afford to pay any additional interest and she said the deadline of July 28th had passed and my only option was to write to the complaint department. I sent two pages explaining my issues as well as enclosing a similar document from American Express as a sample of well written, concise communication that left no room for ambiguity. It also showed that AMEX allowed you to "opt out" at any time up to the rate change date, no deadlines.
The rejection form letter came back with no acknowledgment of any of the comments I made. I feel Capital One was purposely deceptive for numerous reasons. 1.) The flyer was sent out in the typical "junk mail" format with nothing printed on the statement until the month of the increase...SIX MONTHS AFTER the "opt out" deadline had passed. 2.) The flyer was purposely deceptive and confusing. Throwing in the "promotional rate" verbiage made no sense other than to confuse the situation. 3.) It was sent in early summer when a lot of people are on vacation. Would they even see the document before the "opt out" deadline? 4.) What would be the point of an "opt out" deadline other than leaving customers no option but to pay the increased interest? 5.) Their customer reps don't know what's going on. There is every chance that I could have called when I received the original letter and had someone tell me it didn't apply to me as they did last month.
Supposedly legislation in February will stop this from happening in the future, but credit card companies were aware of this and have already raised their rates! What good will legislation do now? Will it be retroactive? As far as I'm concerned, Capital One is by far the worst credit card company out there and I hope someone is able to convict them for their unfair and deceptive practices. While I have followed the rules and have honored the terms of my agreement with Capital One since the inception of our relationship, they have not. This increased interest will be a hardship on my family as more money will go to Capital One and less will be available for other bills we struggle to pay in this economy.

Me and my wife have been married for 10 years, and we both always worked and paid our bills on time. We always heard about the fraud and conspiracy going on in the banking world, so living with my parents for several years, we had my mother depositing our checks and cash in her bank account. She is a credit manager for an electrical company for the past 30 years. In the pre-days of Katrina, my parents moved to Orlando, FL for the same company, but a much higher pay. They prepared to move, so my mother had withdrawn all of our together savings, and said to go to capital one bank, and open a joint account, and a tower gold account, because it was a large amount. The tower gold account was going to be like our savings, unless the joint account had gotten low. The date was 2/23/2006. The accounts were open, and on 3/16/2007, both accounts were over drafted by $4,000.00.
During the start of our experience, we were not receiving our statements, so I would go into the bank, and ask about my statements, and they would tell me that they mailed them. I don't know whats going on. This went on for months. We started getting denied for bill payments, purchases, etc. I tried to have the accounts closed, and this lady at Capital One Bank told me I would have to pay a fee of $5,000.00, for breaking a contract. Me and my wife have separated several times, because of the stress of this situation. I was alone with my 5 and 8 year old sons. By 3/16/2007, the accounts were purged, and a lady fired, because the bank president said she had messed up a lot of accounts. I told her that my account was messed up, and the president gave me the runaround for months. I've been to Capital One around 50 times in 2 years, and they still will not give me my statement, one of the Capital One Bank printed out the last 2 statements from both accounts, and they were well into the negatives. Other Capital One banks in the area would say they show no such accounts, and some would say they were purged from the system.
By now, I lost my wife, and have 2 children to care for. My truck note is 3 months behind, and was threatened multiple times with repossession, and my mother and dad had to help. My father has had 4 strokes in the last 4 months, while my mother has breast cancer. The past 2 years have been like torture. My 8 year son had to be pulled from a private school back then, because of Capital One bank errors (fraud), and being in the negative. My wife finally came back, and my wife and I,and my 2 young sons had to seek medical attention for severe depression and anxiety. I have been literally suffering from this for 2 years. My 2 sons did not have Santa Claus visit our house this year, because of Capital One. On 09/09/2009, I got off from work, and went to yet another Capital One bank to try to get my statements, and this little old lady sitting in the corner of the bank assisted me, and she got my statements for both accounts for that year. When I started looking at them, I almost passed because of what I saw.
On the joint account, it shows that a complete stranger opened up our accounts on 06/12/2006, when we actually opened it up on 02/23/2006. I also received actuarial deposits for when I made a deposit, and on some dates, there are 6-7 different deposit slips on the same account numbers, 1 minute apart, stating all different balances, and on other accounts, there are 3-4 deposit slips on the same day, 1 minute apart, with multiple balances. Upon looking more at both accounts, there are 6 different debit card numbers between both accounts.
I went to the bank president of yet another Capital One bank and showed him, and he told me he has never in his 28 year history in banking seen so much fraud. He told me this is too big for him to handle, and he was going to send it to the fraud unit at Capital One bank, Mr. Marco **. What a big joke! He calls me up 1 month later, and says he don't see anything wrong, and it's out of his hands, and he does not want to talk to me or see me. I have emailed well over 200 federal and state officials, for the past 2 months. I emailed the CEO of Capital One and everybody who works at Capital One, and not one person has called or emailed me back. I can not afford an attorney, but I'd like to sue Capital One bank for 1 billion dollars, for the pain and suffering this company has put me and my family through. I have all the paperwork. This is for real!
The consequences include separation from my wife, severe depression, psychiatrist visits, had my electricity turned off several times, back due rent, car note, and my credit ruined.

At 8:13 am January 4th 2010, the phone rings and this rude woman says she wants to speak to my husband. I tell her I am his wife and can I help her. She says, I have a $3000 debt with a bank I have never heard of before and am I prepared to pay it. I said I had never heard of them and she said she would look into it, then she said "Forgive the call" and hangs up. I am now awake and [upset]. Turns out she left a message on my husband's cell phone too.
To top it off, before she called me that early in the morning she had called my 88 year old Mother-in-Law and brow beat her to get our numbers. Now, we have had 2 accounts with this company, both are paid off. I called and left 2 messages asking for a return call and wanting to file a complaint. After 2 days with no response I called again.
The first man transferred me before I could even get a complete sentence out. The second man was not much better, but once I told him to shut up and listen to me, he looked into it and she had called us in error. We don't owe them money. Now, couldn't she have said, I am so sorry to bother you, I have made a mistake. I told him I intended to complain and take whatever action I could, but that I would say that he was helpful once I got him to quit interrupting and listen to me. My mother in law was afraid there was some huge problem. They made her think it was urgent. She thought it was an emergency. Even had we owed them money, we deserve to be treated with respect.

I don't know where to turn to and get some help with Capitol One. I missed one payment in five years back in July 09 because I needed the extra money to fix my car. So, I missed the payment. Capitol One has not helped me at all. They keep charging me fees for over the limit and being late. I do pay every month but cannot pay the minimum due because of the fees. I asked them to help me, so I can pay it down but they said it was the law that they had to charge the fees.
I find that hard to believe because I have a card with Chase also and they dropped the fees, so I could bring my account in good standing which I did. Capitol One also charged me an annual fee and I cancelled my card but they wouldn't take the fee off. they call and harass me several times a week and I can hardly understand the people that call.
I asked to talk to a manager but they just put me on hold. I'm more than happy to pay this card off but its not possible because of the fees. I have a single income and cannot afford it at this time especially when they keep adding the fees and the bill keeps getting higher. I desperately need someone to help with this problem. This issue is ruining my credit and I have one income and am stressed every time I think of how much I owe them. I do have high blood pressure and it does not help that at all when they call. I cannot afford to pay what they are asking. It's very frustrating to know I'm trying to work towards good credit and they are ruining it. I missed one payment in five years and they won't help me, I just can't believe it.

They advised me to close my account when I contacted them about a late payment. I have been late, but never missed a payment. Now, they have raised my interest rate from 9.9% to 19.9%, right before federal regulations take effect, with no notification, and say they can't change, because the account is closed. I am trying to pay this off to get my bills under control. This is not helping me pay them.

Last May, I received the notice of my rates going up. I called and cancelled my 3 small accounts. I have been paying off on time since. Apparently last October, I paid one account twice and one not at all. Since every time I call for info, they can get into all accounts, it was pretty obvious to whomever I spoke with. I said I would double the next payment and no late fee or transfer was discussed. I now find after paying the $40 in November and $20 in December that my balance is $67 and they are willing to take my payment over the phone for that amount and waive the over the phone payment. How can they get away with this? Is there no one to help us?
How much money do I have to throw away before the government will help me? Do you not think this is ridiculous? Thank goodness I work as a lead agent for a national company and when I get an irate customer I am not allowed to hang up as our Indian rep did or the first American agent did. You see as a company, mine believes that the customer keeps the business open and although I do not give away the store, I certainly would have worked with a customer calling with my problem, especially seeing the obvious transpiring of the payments.

I called in November to get a pay-off quote and I was told it would be $10,764.41 and I made online payment that same day or within the next few days. I checked my bank statements and I saw the money come of my account. I called them today because I haven't received my title yet. I was told that I still owe almost $500 - $489.24 or $492.26. I asked to speak to a manager and they hung up on me. I have to pay $492.26 and they are still charging me interest.

I had bought some Acai diet pills online. I stopped any further orders, but the company went ahead and billed me anyways. Next, I cancelled a magazine subscription and refused any further magazine from my postal carrier. I even went as far as to write a letter to the company. This whole matter is about a couple disputes which were not resolved, and now six month after the fact Capital One expects me to pay for something I discontinued. They refuse to back me up with the merchant. The credit card in question has not been used since the day of these disputes, and I am the only one who has access to the card. I have gone over this matter with Capital four different times, twice today alone.
Because I refused to pay for something I do not have in my possession and I stopped Captial One is more than likely going to damage my credit. I did have good credit until this matter has come to a head. Can you help me.

To make a long story short, the bottom line is: I have paid every penny that I owe to Capital One, and they still have not released my account. I know that this is done on purpose because they faxed the release order to my bank without a signature from the judge. Capital One knew that it had to be signed by the judge; therefore, when they faxed it without the signature, that's already a proof that it was an intentional act and that they wanted to inflict emotional distress on me.
They should not and do not have that right to cause that kind of harm on a human being ever, much less after they have been paid every single penny they claim owed to them. Do I have any rights here? Does a credit card company have that right to withhold a person's bank account when they have been paid completely every single penny?
If Capital One had told me beforehand that they were going to garnish my account, the whole thing could have been resolved before it had gotten to that point, but they waited until two days before Christmas. To wait until then, that act, alone, shows evil intent and cruelty towards me. Apparently, Capital One doesn't want money to be paid, they wanted to punish me because I have paid them the money and they are still inflicting punishment on me by not releasing my account back to me.

After having a Capital One credit card with a 500 limit, I could not longer pay the minimum in 2006 because of financial circumstances, job loss, car repairs, and medical bills. I went over the limit not because of spending but because of Capital One's fees for everything. Fees for being late, fees for being over limit, interest rate changes which put you over limit so that you have to pay more fees, etc. In a short amount of time my bill kept climbing and I kept falling behind. I called and canceled the credit card when my bill was around $700.00. But the fees didn't stop. As of today, I am still trying to pay this bill and it is now over $1000.00. I'm basically able to pay the over limit fee $35.00 and an additional $30.00, which when you subtract interest doesn't amount to much. I'm prudent on paying on time since I don't want the 'late' fee as well.
Anyway they called me 4 times this morning, New Year's Day, to tell me that I am over limit and they would be glad to take a $500.00 check over the phone. When I explained to them that I am only able to pay them what I agreed to pay them in November when I paid them $200.00, they asked about my tax refund. I explained to them that last year I owed the IRS and that I couldn't promise them anything. They said hold for just a minute and I was on hold for a very long time. I eventually hung up. Long story short, I will be glad to be done with Capital One and will make it my business to never do business with them. I liked what Claudine of Sycamore, IL said:

It is ridiculous. I agree. I am still trying to pay a minimum amount that will keep me in their good graces until I can pay a larger amount and get done with this company. As a result of their fees for everything, my credit has been damaged. Sometimes when they decide I need to get under limit they call me incessantly, and the stress of trying to pay that bill every month is something I carry with me all of the time.

I wasn't late and paid by due dates, but Capitol One raised the credit card rates from 9.9% to 17.9%. I called 2 different times. They say that they can do this and won't change my rate back. When I have paid them off, I will cancel my card. After reading other people's nightmares with canceling, I think I will make sure the cancellation goes in registered mail. I would love to see Capitol have a case action lawsuit hit them. Capitol One gave themselves a hefty raise.

When I was activating my new card with no interest for 1 year, I was told 3 times that I will not be charged interest for 1 year nor will there be a balance transfer fee. I was advised to take advantage of the full credit limit, because there are no other fees that would make me go over limit. However, the first statement I received showed a finance charge of $13.90 under special terms financing. The card that I originally had transferred from had APR of only 7.99%. When I called Capital One, they said that this was in my contract under "Special Terms" and that I should have read my contract. They also said there was nothing they could do.
I was very upset, and I sent them full payment through online bill pay. They received it 4 days before deadline, but they posted it to the account 2 days after deadline, so they can charge me a late payment of $39. I called them again, and once again, they told me there is nothing they can do. I closed my account with Capital One, and I advise everybody else to stay away from that company, because they will do anything to rip you off.

I received my December statement from Capital One, and at the top of the statement, it stated that "per your previous disclosure, your interest rate will be rising effective January 2010". I immediately called asking what this was all about because I never received a previous disclosure. I was then told by customer service that in February 2009, I was allegedly mailed a disclosure stating that my rate would be going up in January 2010 unless I opted out by April 17, 2009. I explained that I never received any such mailing and that I should still be allowed to "opt out" since I never received it. I also asked if they had proof that such a mailing had been sent. I was told repeatedly that there was nothing I could do.
How can a company operate like this and get away with it? How can they say well maybe it was lost in the mail but you are still responsible for it. If they are mailing something so important, shouldn't it be sent with your statement to ensure that you receive it or post it online to your account? I mean there should be provisions for customers who do not receive such a mailing. My interest rate will now be rising from 6.74% to over 16.99% and I was told it has nothing to do with my credit or payment history but due to economic conditions.

In December of 2006, this account was turned over to Provanta Corp. for debt settlement. Provanta Corp. was unable to settle with Capital One Corp. Last year, the law firm of Nudelman, Nudelman & Ziering; 425 Eagle Rock Ave. Roseland, NJ 07068 ATTN: ** sued us on 2/21/09. The balance of $7,580.14 was the amount on our account. Now, the balance is over $15,000. Our credit has been ruined.

I have had too many problems with Capital One. I have been a customer for over ten years. Before, they were Coastal, then Hibernia, and now Capital One. When I signed up, they were a wonderful bank. The manager and employees went out of their way to help the customer. Some of their managers were super nice people. They're very understanding. A couple of them were Kevin and Altaf. They have been transferred elsewhere since then.
When Hibernia bought out Coastal, their customer service went down a few notches, however not too bad. When Capital One bought out Hibernia, the customer service just plummeted. I have had several very nasty incidents with them. Most of the good managers they had either left or were transferred elsewhere. The new manager at the Mason Road branch in Houston is super rude.
One time, I and my wife went to use the locker box and waited almost an hour after we signed our names. The manager allowed some people to use the locker box ahead of us. When we asked her why she allowed others to use the locker room ahead of us, she very rudely replied that they had been there before us. We showed her the sign in the sheet and showed her our names were ahead of everyone else's. At this point, she became very nasty and replied that we had left our place in line. The funny thing is, there was no line! People waiting to use the locker box were sitting on couches, till their names were called. However, there is only one person at the Mason Road branch who will still go out of his way to help the customers. His name is Ketan. I know it is only a matter of time before he leaves or is transferred elsewhere.
I called the Mason Road branch one time, wanting to know why the interest rates had gone up so high. It was probably the manager who got on the phone and told me very rudely that they had mailed out notices to everyone and that if I had not read my notice, then it was my fault. Since then, I have opened an account at Wells Fargo. There's a very big difference in attitude. I will be transferring all our accounts to Wells Fargo. They are happy to see you arrive, unlike Capital One. They are happy to see you leave.

My story is a simple one. I had a limit on my credit card with capital one of $7,000.00. I had it lowered to $500.00 for security reasons. I have bought three cars and over $20,000.00 of equipment through Capital One. I have never in my life missed a monthly payment. But because I went over $72.00, I was turned over to collections, for the $72.00. The collection company said they had to have access to my banking account to retrieve payment. I said no. I told them when my bill comes due in 20 days, I would pay off the total amount. They said no. They needed the money now. I hung up.
Over the next five days, this same collection company called demanded the $72.00. I told them again and again I would pay it off when it comes due. I asked them to stop calling because I worked nights and they keep waking me up. They said they will call everyday until they get there $72.00. I called Capital One and paid them the full amount 15 days ahead of schedule just to have the collection company to stop calling waking me up.
I must admit I liked Capital One for many years. Their rates were good and front line customer service was good also. But don't make the mistake I made. Going over your limit to them is a capital offense. Whatever happened to just adding a fee for going over and letting the customer pay for it. Why be such sharks about a simple overage? It looks like to me Capital One no longer cares about customer service. Beware.

The headaches Capital One intentionally caused for no apparent reason is driving me to distraction. First, for well over a decade, I have been calling them asking them not to send checks related to my account anymore. It's too easy for someone to lift them out of the mailbox and use them. The customer agents always agree and assure me they will stop. Two calls a year for over a decade and the volume of checks sent to my mailbox increase every year. I gave up making that request after 14 years. They only send more and more.
Then, they started a new trick. I took the card that hadn't been used in ages and got some gas. I then went to a local shop to pick up a few things. The card was declined, three times. Thankfully, I had my debit card to make the purchases. I called Capital One from the parking lot, having not actually died from the abject humiliation in the checkout line, and was told it was for security purposes. Using the card triggered a lock down on it that had to be sorted out through the fraud department. No real reason other than that was given. No, there was no history of it being reported stolen. Just use it once and it will be locked down according to the assorted customer agents.
Then the past few months have been quite interesting. Someone used my card on the Internet. I said someone because it was not me. I tried contacting the company and got a strange voice mail box. I Googled the number for the company that came on my statement and find slews of complaints on the 800 notes website. Seems it's a scam company that just randomly charges cards.
Several months ago, I had a strange charge on my unused card. I do not recall if it was the same company. I called, and it was removed, no problem. It has been very different the past two months. I saw the charge, called and spoke to a very nice lady who said it would be investigated and as it was the only charge on my account, I had a zero balance. I picked up my mail and what's in there but a statement from Capital One. Another fraudulent charge perhaps? Of course not, they took care of that. This was for interest on that fraudulent charge that had been removed, a whopping $1.85. That's right, one dollar and eighty-five cents.
When curiosity got the better of me, I called today as I just had to hear the logic behind that stellar business decision. The agent almost asked me if I was stupid for writing and mailing a check for a dollar eighty-five, but caught herself as it was halfway out of her mouth. She credited it back, but that was far from my point. It was decided that it would be best that I call in to the 800 number every single day as long as I have the card to check and see if there are any fraudulent charges so I can report them instantly to stop accruing interest on them. I am apparently responsible for all interest regardless of the fact it stems from a charge they admit is fraudulent.
I have been a customer of Capital One for a number of years since college. I have not had a late payment or any trouble with them until this bank bailout/free for all occurred. I am very grateful I have been able to make payments when asked and have a pretty impressive credit score. All the above combined tells me that Capital One's actions are not a result of a massive percentage of their customer base falling behind due to hard times. This looks very much like a corrupted pattern of behavior that Capital One obviously feels no worries or fears of any sort of consequences or punitive ramifications.
There was gossip regarding the nature of my finances when I was declined for purchases I was trying to make at Rose's Discount Store. I live in a very small community and word travels fast. Also, having to call every single day to check if any charges have been made to my account for as long as I have an account with them has actually caused me to lose sleep and is stressing me out. My dentist is going to flip when he sees the result all the stress related grinding has done, all due to Capital One. If I close my account, I hurt my credit. If I don't and don't spend a portion of my life checking in with them daily, they will ruin it anyway.

The company raised my APR from 12.99% to 22.90% without informing me. This has caused me to over my credit limit ($1,000) thus incurring late fees. Although I am in good standing, they refuse to make an adjustment upon my request. They stated that due to the current financial situation in this country, they as a company had to make certain changes to customer accounts. I told them that this was illegal based on government regulations and they told me that they would contact me in the future if any offers or adjustments would be extended to me. I've been with this company for 6 years and this is the poor customer service that I get. Please help. I have incurred more debt as a result and I am not making any progress on shrinking the amount on my account. This is corporate bullying at its worse.

In 1996, I applied for credit with another institution. When I received a letter from Capital One saying my account had been approved, I mistakenly thought it was the company I applied to. I sent the deposit, they sent the card. A month later, I got a card from the company that I actually applied to, but I had already used the Capital One card to the tune of about $185. When I received my statement at the end July, I was unfortunate enough to have both the statement and credit card stolen at the same time. I contacted Capital One immediately and requested replacements (August 6, 1996).
Two weeks later, I had received the replacement card but not the statement. I did not have any documentation from this account (remember I did not actually apply for the credit) so I called and informed them that I could not make a payment without the bill. They gave the mailing address to me (the payment was due the next day) and promised to send the statement, I promised to send a payment that day. Two weeks later, I received the next bill with a $20 late charge and a $20 over limit charge (their charges took me over my limit).
When I called to complain (the delay of the payment was their fault and not mine), they refused to waive the charges. I called several times, staying on hold for over 45 minutes one time, to speak with a supervisor. I was told by "supervisor" tough, not their problem. By this time, another statement had issued and in spite of my payment, was once again "over limit" and another $20 was tacked onto the balance. I immediately sent all of the money that I had charged on the card plus interest along with a letter demanding that they close the account and delete the $60 in charges they had put on the account. They held the check and the letter for 4 weeks, then cashed the check and "closed" the account (after adding another over limit fee and another late charge).
At this point, they spent the next 6 months calling me daily. I explained the situation repeatedly to their collectors. I refused to be responsible for their "fees". I asked them who they answered to and at that time (according to them), they were owned by private investors (they were not yet a bank). There was no regulatory agency to appeal to and I did not have the money to hire an attorney. They ran up a $900+ balance before they finally stopped adding fees.
After 13 years, I still get calls several times a week from the collection agencies that they periodically release the "debt" to. These collectors will not go away, ever. I barely make ends meet and can only afford my one phone, no cable and live in a mobile home. If I was hoping our new government would make things better in regards to credit for the consumers who struggle, I was wrong. Let the buyers beware, if you don't have money, you don't have the means to defend yourself against these people. They will take advantage of you.

I'd like to share with you a concern I have with regards to a very substantial rate increase I recently received from Capital One (MasterCard Account). My credit score is in the mid 700's. I have never been late or missed any payment in my life and take seriously my financial obligations. For no reason, my interest rate just went from 7.9% to an adjustable rate, currently 17.9%. I've contacted Capital One and was told there's nothing they are willing to do about it. I have an $11,000 balance and things are very tight in our household as it is. My monthly payments will more than double.
To make matters worse, I had a zero balance on my account several months ago and I will say in all fairness to Capital One, I did receive a letter from Capital One describing an upcoming rate increase. The letter was not very clear and as I recall was in a non-descript envelope (something most people would toss out as junk mail), and since I had no balance at the time, I probably didn't read it as well as I should have. The point is I called Capital One about three months ago to question what my interest rate was and to check on what my interest rate will be once the new terms go into effect. I was told by customer service that the 7.9% rate was my existing rate and they did not see that my account was scheduled to have a rate change.
Based on that call, I transferred $12,000 from a higher rate card to Capital One and thought I would be alright. Now I come to find out my rate will almost triple. How can this economy recover when people like me are paying more money in interest and have less to spend on goods and services? I realize the latest legislation passed to help the consumer may be good in some areas but overall the negative impact regarding the rate hikes that I'm seeing can only further damage and or slow down this economic recovery.
Sir, I ask you to please put yourself in my position. How would you like to wake up one day and find that your credit card rate tripled for no reason other than extreme greed of those who run our banking system? You know; the same banking system we the tax payers bailed out. This is just another financial blow my family has had to endure and I would greatly appreciate any assistance you can offer. My monthly payment will almost triple and now the length of time to pay this card off will be extended costing probably several thousand dollars more in interest.

I sent my payment on November 20 by electronic check. The payment was not due until December 9 but I always send it early and I guess I typed in the wrong amount by $1.00. I sent $105.00 and they said it should have been $106.00. Because of this, they have raised my payment to $140.00 a month. Capital One is not a good company to deal with. I hope everyone thinks twice before they use this company. I closed this account because they were going to raise the fixed rate and I could not afford the higher payment. But they found a way to raise it anyway.

I was getting calls on my cell phone all day from a 714 area code. When I went to answer the call, it would hang up. So, I would call the number and go into Capital One's system. I would give them my details and then ask why they were calling. It turns out that my payment was late by a day. They had not gotten my payment. So after I took care of this, I kept getting calls! I called back and asked for a manager. I would then be placed on hold for 15 minutes at a time and then hang up and call back. I am not sure where the call center is, but I can only guess without saying. I finally got a hold of someone who spoke clear English. At first, I was happy. Then, it quickly fell to the floor when Ryan started asking me why I was happy about that. I told him I could not understand the people that didn't speak English very well or with a thick tone.
Ryan quickly got to being smart on the phone with me. I then told him that I wanted to speak to a manager. I didn't have my account info with me so I gave him my SS number and he pulled up my account and then started taking shots as to why the system was calling me. I explained to him I understand how that works, but it's bad business to hang up when the person answers the call. He started to chuckle on the phone and told me to just pay my bills. I have had two accounts with Capital One for years. I pay my bills and don't run high credit, I was late by a few days. Then, he quickly put me on hold and then it hung up on me.
So to this day, I have yet to speak to a manager. I am just going to close both accounts. I bank with USAA, I have a card with them but will get a second card after closing down my Capital One accounts. USAA has always been great and they all speak clear English and are all located in the USA! If you know anyone that has a Capital One account, tell them to close it as fast as they can.

In May 2009, I received an offer of balance transfer at 0% interest for the life of the loan. I was quite happy to accept. When I called, they said that letter wasn't meant for me and I should disregard it. I insisted they live up to their obligation and they relented. I transferred about $1,000 from a high rate card and was assured several times that this was indeed 0% for life. This month, December, I see they have merged this "special transfer" into my purchases which have a 15 % interest rate. When I called, they told me the transfer was only for 6 months. I insisted it was not but the phone droid was unrelenting. An attorney told me short of suing them I'm out of luck. I think I have another option, tell them to stick it where the sun doesn’t shine! It raises my monthly payments to a level that is difficult to pay, not to mention they are liars.

So here it is Christmas. We played our cards right (so we thought) and paid down the balance on our Capital One MasterCard so we could use it over Christmas - gifts and visiting out of town. We planned out what we were going to buy the kids with smiles on our faces and set about doing it! Ho! Ho! Ho! It's going to be a good time. Well that's what we thought was going to happen. Someone at Capital One thought it would be appropriate to send us a new card that we didn't ** ask for and cancel our current card!? We, of course, were totally in the dark as our current card doesn't expire until well into 2011! **?!
So here we are, a week before Christmas. All our money (cash) went into paying down the balance and now we can't use it. The blockhead at Capital One has cordially informed us that our new card won't arrive until after Christmas. Screw you and merry Christmas. Who at Capital One thought this would be a good idea?! How much more incompetent could you possibly be? Combine this with the total lack of interest in helping us fix the issue for Christmas and you can bet we will be transferring the balance elsewhere ASAP. Big, big thumbs down to Capital One! Not even a heads up? Is that how valuable your customers are Capital One?

I have been robbed by Capital One Bank. I was just charged $210 in overdraft fees and that amount was deducted from my direct deposit pay. I called and inquired about the charges. I was told that my charges of the previous week, which were reflected as deductions to my account in real-time when I called the automated line provided by the bank, had actually not been "posted" to my account until Monday, or December twelfth, 2009. On the same day, I had over drafted my account by forty dollars and was anticipating an overdraft deduction for thirty five dollars. However, Capital One is charging me from the "highest to the least" apparently and so, I am being charged for not only the anticipated thirty five dollar fee for the forty dollars I was aware of, but also for charges I made when I was informed that I had a positive balance; a total of six overdraft fees.
I believe that this is a deceptive and unfair business practice, and just another way for banks to earn revenue off of people who are counting on their money being safe in a bank. If you are a victim of a robbery before you even leave the bank, there is a real problem! I will not be able to afford Christmas gifts for my children who leave apart from me in New York. I can't afford to buy an Xbox, and I may not be able to make it to my next pay period without a loan at a high interest rate. I am also very disappointed in Capital One Bank, who prides itself on protecting its consumers against fraud and theft.
I have been bullied and victimized by this bank with overdraft fees in an amount well over one thousand dollars since opening an account in July of 2009, some of which I was responsible for. But with each instance no matter what I did to adjust my behavior, I have not seen or experienced any reciprocation from this bank. I would also humbly ask for info on how to proceed with a suit against the bank. I cannot afford to lose two hundred and ten dollars. For me, that is equivalent to almost a week's pay. Thank you.

I would like to have some help in this case with Capital One credit company. They sent me a credit card with the intention of providing a good service and the best service in the market of credit companies. What I received was aggravation and more than that, very hard situation inside of the stores. When I went to pay for the items at the store, I couldn't buy the things I had in my hands. Denied was the response from Capital One. Now I contacted the credit company again to verify this situation of discomfort and the need of credit records. The cold answer from them is I have a bill for $54.00 that includes a past due payment of $15.00 and the annual fee in advance. Also, they stated that the card can be used and the result is the same.
My question and complaint is, those companies are allowed to abuse the customer the way they like it without mercy?! On top of the depression?! Please, can you give me some answer and help me with those kinds of abuses that leave me sick and frustrated? More, if that is not enough, to use this card, I have to send the payment they required in the statement on the due date. This card has never been used by me.

Tonight, I received a call from Capital One to inform me of changes the federal government will be making in 2010 and the caller asked me if I would agree to some overcharge protection that I've had. I told him that I make my payments on time, and usually over the minimum, yet I can't get ahead because they keep raising the APR. He said that he looked up my account and I was a perfect candidate to have my interest rate lowered, that I would just have to call customer service. He told me that I had to decide whether to continue the protection right now. I agreed and as soon as I got off the phone with him, I called customer service.
I was told that I have the best rate they could offer. They refused to let someone like me get ahead. They're making too much off raising my interest rate. Supposedly, they review accounts and interest rates and they'll let me know if a lower rate becomes available to me. I can't get ahead. I make my payments on time and over the minimum, and they're bleeding me. Because money is going to Capital One, I can't put it towards other obligations. How is it right that an honest person isn't allowed to pay down his or her debt? This is emotionally distressing, and as I work full time and look after my mother who has dementia, my options for earning extra income are limited.

I am plagued with credit card applications. I sent off a letter on November 3, 2009 to a Mr. Michael ** requesting to be eliminated from your mailing list. I am still getting such mail. I’ll say it again; get me off of your damn list, now. I am tired of shredding this unwanted garbage. My next letter will be to the BBB with a copy to the CEO. I am not interested in your credit card.

My last satement from Capital One charge card shows that they cashed out my mileage points totaling 2,668 (according to the previous statement) and credited my account a mere $5.34 for the total points accumulated. I did not request this cash out and was very surprised to see it was done. When I called to inquire about this, I was told a letter had been sent out notifying me that they were ending the mileage points for this account with instructions for what I should have done and since they did not hear from me, they gave me the mere $5.34. The reward should have been 1% or $26.64 if this would have been cashed in by me. I explained to them that I did not receive the letter they said they sent and requested that my account be reinstated back to its original state, but they insisted rigidly that they could not do this once it had changed.
I explained that I live in an apartment community and that the address they had been mailing my statements to was incomplete, without an apartment number. I had once before called them to let them know I had not received a statement. However, they did not care about the circumstances. As far as they were concerned, they sent the mail and did not get a response from me. No further argument or discussion. When asked why I was not fairly credited the 1% of $26.64, they said it was up to the Rewards Department and transferred me to them. When I talked to them, they said they could not help me because they could not retrieve my credit card number in their department and transferred me back to customer relations.
Round and round I went with customer relations. I spoke to 4 people (2 supervisors), who adamantly said too bad for me. Nothing they can do. The Rewards Dept decided on the amount. I think Capital One is very unethical in dealing with my complaint and how they went about removing my rewards (although small) and giving me 1/5th of the value of the cash out amount.

This is December of 2009 and back in July of this year, I closed out my Capital One credit card because they wanted a so-called member fee. Since that time, they took off that member fee of $29 and left my outrageous interest rate the same. So while I'm paying this off, my account is in what's called a "designated to close" state. Anyway this month, I received a statement and on it, it included a member fee again. I called them up and said, "Hey, I closed this account and haven't used it. I cut up my cards and you, so why have you charged me $29 for a member fee on a card that's not even being used." Their reasoning behind all this was that I hadn't paid off the balance in 90 days and so every six months, they'll charge that member fee. ** is what I was saying since this was just outrageous!
Anyway, they told me there was no way to take off the $29 even though I was paying them about $23 a month interest. I told them they wouldn't get another penny from me and they won't! It might mess up my credit, but to be affiliated with a company that is that messed up to an individual customer... Hell with them. I'll just wait and have a credit restore company fix it, they won't get another nickel from this unhappy cardholder. Wouldn't you do the same?

On 6/26/2009, I was just about to pay my current bill when I saw an alarming balance to my credit card bill. After reading this message, I surely hope that you will reconsider what you are asking me to pay and provide some sort of relief by making an adjustment to my debt. Your slogan of, “What’s in your wallet?” should be, “Let me stay in your Pocket”.
During these hard and difficult times when just keeping the lights on, keeping a roof over me and my family’s head, and putting food on the table, I have to deal with trying to pay Capital One payments and you are just continuing to charge me over limit fees. My balance of $543.52 as of May 27th shows that I was only a little over $6 in over my limit, yet you charge me close to $50 in over limit fees. Then to hurt my family even more where again you charged me another over limit fee and now my balance is $582.52. Here it is June 26 and I have not used the card in over a month but yet I am close to $100 in charges for the month!
This is exactly what the President and Congress were talking about when they passed a law declaring credit card companies to stop draining the American public into more debt when they can barely keep food on the table and keep their homes. You should be ashamed that you are continuing the same old practices during these rough economic times. The bill passed by congress requires that you not only stop with increasing the rates you charge, but also that credit card companies allow a 60 day window for payment instead of the 30 day because of the struggles that our nation’s consumers are now facing.
Do I not pay for gas to get to work, my mortgage, electricity, or groceries in order to pay you close to $100 in late fees because my last purchase put me a little over $6 over my limit? I am deeply saddened that Capital One is still practicing how to destroy country’s infrastructure by destroying the root of its development; the consumer!
You can best believe that I will bring my story to the attention of President Obama and Congress should nothing be done to help ease the pain during these hard economic times and make this wrong right. I have been a customer of yours for a number of years and you have only continued to charge me unnecessarily with charges and fees. I pay my bill every month and because of emergencies, I had to use the card in early May. I still have the same credit limit that I started out with and have been without an increase ever since. But yet still remain in your debt and you in my pocket! My intent was to pay $25 today (which I will do) because that is all I can afford right now. Mind you, it is $10 more than my minimum of $15 but what will it do? Absolutely Nothing! Why, because you will hit me with interest, another over limit fee and whatever else you choose to do because I am at your mercy!
In closing, in a time when we as this nation is trying to recover during a very bleak time in the history of this country, you still choose to line your pockets with your credit cards in our wallets! I made this complaint and followed every step that they asked. I never received any response to my concerns/complaint and even after they froze my account they still hit me with overdraft/interest/late fees! They have doubled what I owed them and doubled my credit limit, yet never gave me an increase and always paid them on time prior to the May incident. Even after they said they froze my account, I now have a bill of $1,005.39 as of 12/11/2009! I am asking for your help to intervene on my behalf since Capital One will not work with me! Thank you in advance for you anticipated cooperation in resolving this matter.

I received a promotion from Capital One stating that I qualified for a professional card, which included no annual fee and airline mile credits on all future purchases. I currently have a platinum card and have always been happy with the service from Capital One. When I asked for my platinum card to be transferred to a professional card, I was told that Capital One's policy is not to transfer existing customers to the new program and that I would have to apply separately for the professional card. I have been an excellent customer for the past several years and feel that I should not have to apply for a new card as I do not need a second card with the same company. I was told by the supervisor that cancelling my card would be reported to all three credit agencies and would be a negative mark on my credit reports. Regardless of the intimidation of my credit possibly having a negative mark, I canceled the card.

I am very unhappy with Capital One Bank. They are increasing my credit card interest rate even though I called in the allotted time to "opt out" and keep my current interest rate and payments. They have no record of my phone call and will not honor my request.

I called to ask to get my interest rate reduced due to economic hardships and other outstanding bills that we have. The 29.4% rate is extremely unmanageable. I had met with a consumer credit counselor who advised me to first reach out to creditors to see if a reduced rate could be agreed upon. I have called Discover card and Chase and both companies understood my problems and had specific programs to help people in my financial situation to pay off the credit card within a specified time period. I would have liked the same experience when I called Capital One but there were no programs that they had to help consumers and the only people I spoke to spoke in broken English and it was as if the calls were being routed to a call center in India where they were told that all they should say is that "we are sorry, but there is nothing we can do to lower your rate."
It really is frustrating because with the additional help we have received from other creditors, we really don't need CCCS's help but due to the lack of professionalism and the fact that Capital One does not have a program set up to help those under financial dire straits make me want to go to CCCS and have them set something up with Capital One just to get a reduced rate. I just can't believe the lack of professionalism I experienced from a banking institution. I just wonder what they would do if you default on the card, if that's what it takes to let them know you really need help. It is just really a sad company that can't help their clients when they are in need. Probably a contributing factor to why the current economic state is like it is.
This bank is just greedy and not a company anyone should partner with. I will pay the minimum on the credit cards I set up terms with and work to get this card paid off first while not using the card for any further charges. I will also use all of the "rewards" points I have saved up for services I need and use to try to help my economic situation. Once the card is paid off, I am going to cancel the account and never work with this bank again. I will also tell everyone I can about the bad service I received and recommend that they don't even consider starting an account with Capital One.
The economic damage is that the other credit cards reduced their rates to 6% or lower and I'm still paying 29.4% to Capital One. If they could have reduced the rate, I would be paying $680.00 in finance charges a year but instead I'm paying $3,381 in interest per year alone! This is a difference of $2,701. With having to take unpaid furlough, pay cuts, medical bills and owing the government $3,000 in tax money this year, I am just wondering how everything will get paid. Physically, I am very emotionally upset and worried about my financial condition to pay off everything. It makes me depressed and very concerned. I was amazed that they could offer no assistance at all.

I was paying my bills today and I noticed the Capital One finance charge seemed very high so I looked below to check to see if the rates were correct. My 15.9% interest rate had been increased to 22.9%. I called right away and explained there must be an error. No, they notified me in May that, in August, my rate would go up. I said I never received any such notification. I pulled out my old bills to see if it was there and I missed it. They said, "oh no, it was sent under separate cover."
From there, over an hour of arguing ensued; I spoke to three different people. They kept saying "they were sorry for the inconvenience". Inconvenience! What kind of double talk was that! And I said it's hardly an "inconvenience" to have a significant amount of money more or less extorted from me under the guise of an advance notification that I never got. So, I went to the web to check to see if others had a similar issue with Capital One. Sure enough, others on this very site had the same problem with "alleged" notifications that, in fact, were not received.
I've never been late, never missed a payment. Chase also raised their rates but they sent an opt-out notice giving their customers the option to choose a higher interest rate or close their accounts. I called my Congressman and Senators and have begun paperwork for an investigation to proceed. Of course, all the credit card companies were aware that the legislation preventing hikes of interest rates on past purchases had an effective date of Feb. 2010 to December of 2009. I asked my Congressman why they didn't put the legislation into immediate effect when they first wrote it and/or make it retroactive to the date of the original legislation since the credit card companies rapidly stepped up their campaign of exorbitant interest rate hikes.
I was told it's hard to get legislation through. Well, of course it is. Go to Open Secrets and check each legislator's funding from financial institutions. So basically, credit card companies were given a year's advance notice about what restrictions were coming their way with respect to unfair business practices with their customers. Gee, they got a whole year to get out of Dodge; many of us didn't get any notification there was going to be new rules.
The practices are worse than deceptive; they're parasitic; it's high time American citizens started doing something about our loss of rights in favor of big business corruption. Most of us have lost 25% of the value of our homes going to corporate financial fraud, and we have a $3/4 trillion debt to pass on to our children and grandchildren, thanks to the bailout of the crooks. At least, complain to your legislator and have them send paperwork to proceed with an investigation.

Starting in 2007, just after I received my free annual credit reports, first, Capital One illegally stole my credit bureau records. Then in early 2008, Wells Fargo, with whom I had closed a Visa account in 2000, illegally stole my credit bureau records. Then another company, who refuses to respond to my written demands they educate me as to what legal rights they have to my credit bureau records, also stole my credit bureau records. All this theft of my credit bureau records was done while I had opted out with all 3 major credit bureaus. In addition to this being outright theft, it is an illegal invasion of my privacy. I am the most amazed by the action from Wells Fargo because all my credit bureau reports clearly show I closed my account with them in 2000. I am certain these companies have shared my data with their family of affiliates and third party marketers to their additional gain and my additional loss. I need to know:
2. What are my damages from this egregious breach?
3. What are my damages from Capital One and this third company for stealing my credit bureau records when I have no relationship with them and have not requested any business from or with them, etc?
The last issue I have is in September of 2008. JC Penney sent out a notice advising of a change in terms to an existing account. They offered an opportunity to opt out of arbitration, along with the exact steps you had to take to effect this opt out. The terms stated in writing my adverse action would be taken if you chose to opt out of the arbitration. I chose to opt out of arbitration and followed their exact steps to effect that opt out. I discovered one night after work, when I went to pick up a catalog order from the local JC Penney store, that my account had been closed. I was at the counter after having waited approximately 20 minutes in the long lines at the catalog counter. So my discovery was where I was effectively, publicly humiliated by the clerk announcing that my card was no longer any good, that my account had been closed and that I had to immediately pay off any existing balance on that now closed account.
I called JC Penney to find out why my account had been closed and I was informed that by me having opted out, I had closed my account. This is of course contrary to the written terms. Clearly, I had been retaliated against by accepting their offered terms and following their directions. Of course, having my account closed also had a negative impact on my credit score.
I tried to talk to JC Penney to no avail. I wrote to them twice with no response. I finally hired an attorney who also wrote to them. His first letter was not responded to because he had not mailed it certified. He mailed his second letter certified and eventually got a response saying it was all an unfortunate mistake and the account would be reopened. In the meantime, all the credit bureaus had been notified by JC Penney that my account had been closed by me effective October 2008. As of June 2009, JC Penney still had not reopened my account nor had they notified any of the credit bureaus and corrected the unfortunate mistake. This is of course in violation to the FCRA laws.
Finally, I sent them certified a demand letter for financial damages in July. I believe they finally fixed their unfortunate mistake in August but of course, the credit bureau records did not get corrected until September. Almost one full year. I am certain my experience was not an isolated event and who knows how many JC Penney cardholders got caught in this trap. I decided they owed me for all the grief they put me through, the fact that I had to hire an attorney to communicate with them, etc. I need to know what my damages are.

Capital One had sent a credit card that we no longer could pay due to my husband becoming ill. They sent it to their collections company called NCO or ISO (can't remember). After paying the amount, in which our credit limit was $500 and after service fees, etc., the amount paid was $3,400.00. We asked for a letter stating that the amount was paid in full. We did receive one from their collection company (who by the way Mr. ** from the collection company has no people skills and should be fired) but Capital One states that they have 30 days to send a letter stating that the account is paid in full. It shows on their records that it is paid but will not release the letter for 30 days.
After two days of calling, you can't get a real supervisor, everyone taking the calls claim they are supervisors or Account managers. After checking with the credit bureau, they show that Capital One shows the amount they are owed along with their collection company that shows that their creditor Capital One has an account owing with them. So really! Capital One can get paid twice for the amount! This has really caused a lot of stress for me, since we were ready to close on a house, and everything got held up for that one piece of paper that Capitol one would not release till after 30 days.

On my September statement, I noticed a charge for $93.90 at an online retailer. I knew I didn't buy anything, so I immediately called Capital One to tell them my account was used without my knowledge or consent. They removed the charges and sent me a letter dated September 21 that stated the amount was credited. I thought that was the end of it till October 7. I saw online that the charge was re-billed. I called again, and was told I would have to fill out a form stating I did not make the charges, and sign my name. The forms never came. I called again on October 19, no forms. I called back, on October 30 (and of course one can never get the same operator) and was told I did not wait long enough, that it could take up to 30 days!
I called again on November 10, and asked that they fax the information. Again, no paperwork. Another call on November 24, finally, generated papers that arrived on November 27. The cover letter was dated November 24, but the forms were dated October 7 (stamped "Backscan") and due on October 22! I faxed the forms back right away, and called the following Monday to confirm if they were received. I was told at that time that the matter was resolved, and I would be getting a letter. They refused to tell me if the charges were removed. When the letter came, it stated that I still owe the $93.90!
I went through 3 operators the next call trying to get someone in charge. After an hour, I finally got the "supervisor" to tell me the transaction number and details of the transaction. The purchase was made at the Canadian branch of a well-known retailer and shipped to Tennessee; we all do that, right? I found a customer service number of the retailer, and found they have a fraud department. They couldn't have been nicer. As of today, they tell me they posted a full credit to my account. (I'm still holding my breath till I see it posted on Capital One.) I am anxious to close the account, but they won't till there is a 0 balance. They won't even put a hold on it to prevent future problems.
The payment was due today, so I paid the minimum just to be sure they don't hit me with late fees in addition to the finance charges they insist I must pay. I can just picture them having drinks on me in Mumbai! (I have the majority of operator numbers and their fake names)
Consequences: I spent at least 9 hours trying to get this resolved, and much worry about the only credit I have established for my tiny business. It seems a lot of time for under a hundred bucks, but I'm sure that's part of the reason why they didn't care to solve the problem. This has been a bad year for my business. This just added insult to injury. I expect better of a financial institution, especially one that took bailout money from my tax dollars.

On September 1, 2008, I paid my Capital One credit card off and stopped using it. On August 27, 2009, I received a call from Southwest Airlines asking me if I had just purchased 3 airline tickets online using my Capital One card. I told them I hadn't and to reverse the charges. I then called Capital One and told them about the charges and that I had not made these charges. I asked them to cancel my credit card. They said they wouldn't cancel it but issue me another card which I never activated. They told me to ignore the bills I would get that the charges were being reversed.
Two months later, I start getting phone calls from them about paying my past due bill. I explained to the person that could not speak English that I had not made these charges and was not responsible for them. After 10 minutes of being told I need to make a payment and I refused to do so, they told me to call customer service. Finally, someone spoke English and she helped me dispute these charges that were supposed to already be taken off.
I received a letter from them telling me that the charges had been taken off and all finance charges late fees and credit bureau report would be adjusted; that was November 20th. Now here it is, December 8, and they still refuse to take the past due and finance charges off and take the credit bureau report off. I still haven't talked to anyone that speaks English. As for me what's in my wallet? Discover. Consequences: a bad credit score that is being made worse.

Capital One is guilty of FDCPA violations including calling our relatives although they've already talked to my husband and me multiple times in one day. They call before and after hours and from different numbers. They also harass you. They took 2 car payments out of our account. One was unauthorized. They promised to give back the overdraft fee, etc. and our bank wrote them a letter. We never received the money and then they repossessed the car when we told them they were guilty of FDCPA violations and that we were going to an attorney.
We filed a police report. They trespassed when asked them to leave, etc. Their credit card division is worse. We have been called names and threatened. I'm sure we can do a class action suit. Is anyone aware of any that have been started? They need to be stopped and if our government wants to meddle in capitalism (which they shouldn't) and bail out the banks, then they better darn well be the solution and put the smack-down on Capital One. This company is out of control and we all need to do something about it.
Consequences: Emotional distress, harassment of minors in my home, my relatives that live hours away, caused my bank account to be overdrawn with unauthorized withdrawals on the account, broke laws, etc.

I called to question an overlimit fee that was placed on my account after they added a yearly usage fee. They told me that the law passed in May did not apply to existing card holders, only to new holders. They said they are allowed to charge any fees they want in accordance to my original agreement regardless of any recent law changes. I pushed and pushed and they did agree to waive the overlimit fee this one time, but insist that they are correct in charging fees to existing customers. They refused to waive the yearly usage fee or past due fees.

Our business checking account had two fraudulent transactions against it in the amount of $97,196.44 in February 2009. These fraudulent items were originated through Capital One's Online Business Access, TowerNet, and were discovered by our company the business day following each of the transactions and we notified Capital One of the fraud. We have not been reimbursed for our losses.

I have had a credit card account with Capital One since 2001. I was never late, never missed a payment and always paid above the minimum due. I was not notified of a change in terms to my fixed rate credit card which is now a higher adjustable rate. There are many other complaints on this website stating they, too, did not receive the required Notice of Change of Terms. I only happened to notice the change after 4 months, never expected it since I had the same rate for 9 years. I immediately contacted them to opt out of the change of terms.
Customer service insisted I received a Notice of Change in Terms in May, and that my account has always been an adjustable rate APR; however, I have kept accurate correspondence from Capital One and did not receive the Notice and my statements clearly state a fixed rate prior to July '09. I faxed copies of my statements along with my letter and my original letter from them when I opened the account. No one will contact me back. In fact, I have been transferred 6 times and hung up on twice in the last 2 days. I am also unable to "opt out" of the change in terms since the time period for that has expired. Therefore, I am now forced to pay the higher interest on a closed and unusable account.

Every time I was set for an increase of my limit, I will mysteriously go over the limit. I asked the lady how I can go over the limit if I haven't used my card. She gave the runaround saying that a charge didn't post yet and I had no available credit to use and that made me go over. I told her the statement before I was billed for that charge and paid that bill. She then proceeded to tell me that same thing again and I asked her. I had already paid that bill in the earlier statement and I asked her why is it when I'm eligible for an increase, I go over; it never fails.
I told her I was dissatisfied with them and I wanted to close my account and she supposedly did and she explained to me about paying off the balance and I agreed to pay off the $500 the over limit fee. Then, I started to get bills for over the limit and late charges, finance charges. So now, a card that was $500, I now owe over $1000 of which $700 are fees. I don't think that was fair and when I tried to get someone about my account, they kept saying there was no one.
So here I had a negative credit rating because I haven't been able to pay this account's minimum payment of $388, out of this world interest rate increased on a card that was supposedly closed. All I wanted was for the lady to explain how I could go over and already have been billed for a transaction, have it to come again next month and throw me over the limit.
I have had it with these people. They continue to say there's no one else to talk to. They got my cell # and call me 4 to 6 times daily and my home phone also 7 times day. It is aggravating. I know I owe the $500 and will be willing to set up some arrangements to pay that amount. But If your account is closed, how are they still able to bill you monthly? They are some of the rudest people when trying to have a conversation. Every word is pay your bill.

I had 2 cards with Capital One. I made a balance transfer of $3000 on one card at $5.99. They transferred it after one month to the other card and made it a $17.50 cash advance. After 3 hours on the phone, no one would correct it. I paid it off and hopefully it closed the account.

My ex-wife was found to be embezzling money from her employer and paying off not only my credit cards, but also her friends’ credit cards as well. Long story short, I called Capital One and asked to put my account in suspension and to put a fraud investigation in it till I can figure out how the money was dispersed and have them set up a restitution account in her name so she can soak up this debt. I was told fat chance for me to pay. I was in Iraq for the better part of our marriage or Afghanistan, whichever the year was. Bad customer service. They are not very understanding of this situation. I have all kinds of supporting documents to support me to include police investigations in two different states. She did this over three years and two different state police agencies were involved. They (Capital One) didn't want any part of this supporting evidence. Jenifer told me, “How are we going to get our money if she is in jail?” **. It’s not my problem. That is theirs! Am I wrong to say this or think of this?

Five months ago, I was unable to pay my monthly statement/minimum balance on my Visa card with Capital One. I am a self-employed home planner (sole proprietor; zero employees) and I work from my home and have owned this business for 18 years now. The housing market is miserable with little or no work in our area of Southern Illinois, so I turned my attention to other works, namely smaller commercial projects. It has kept me busy, but I have seen my income decrease for the past 3 years and am experiencing much longer time spans to collect money for the work I do. Being late with this payment caused a $39.00 fee to be charged to my account. This fee amount put my balance over the limit of my account. Another over limit fee of $39.00 was charged to my account. I have tried repeatedly to talk to Capital One to have these fees credited back. I even asked about the high interest which was being charged due to the balance increasing and was told they could do nothing to help.
Needless to say, I was mad. I have a Capital One business account and the same thing happened that month. And when I explained the same reasons why I was unable to pay the minimum amount by the due date, their representative took the time to work with me by crediting the two (2) fees to that account back, to lower my interest rate and to waive any fees for the next three (3) months in order to help me get caught up.
I was very thankful for his help and I now am current with that account. When I told Capital One that their business division was ready and willing to do this, I was as much as told that they were a different division and would not do the same. I have not and will not make another payment to this account since Capital One will not stop at harassing me with three to four (3-4) harassing calls each day, each week, each month for the past two months. I have offered a very practical and fair solution to this problem by asking them to set this up as a simple interest loan for no more than four (4) years so that I could pay the balance with interest and know that I was paying down the principal and to have my Visa account closed. I have faxed this information to their office to the number given to me by one of their supervisors and have received no reply.
I asked that they do not call me anymore to harass me with their collection methods and they have not responded to that request either. The calls keep coming. I am at my wit’s end on this, but I will vow to allow my credit score to fall to a 300 level if that is what Capital One wishes to do to me. They have already caused damage to my credit score over this and I was told by their collections department that they would continue to do so. Is there anything someone like myself can do to remedy this?

Continuous calls in regards to credit card payments. Calls are made 6-10 days before the due date on the monthly statement by persons not even located in the United States. Five to six calls per day are being placed saying that payment is due although the paper statements indicate a later date. They keep calling to try and get money delivered over the phone earlier than it is required to be paid. They are rude and barely speak English.

I had closed my account in October, paid off the balance in full, and received a tracking number ** stating the account had been closed. I just received a new statement with a charge and interest. I called and spoke to an account manager who was rude and told me the account was not closed as I had directed. This is a bad company and they have no customer service skills.

I was trying to get determination why their required monthly payment are less than the required amount of money to bring in under the required credit limit. I was behind on my account and made the required late payment to bring it current. The problem is during this time even with the lump sum payment to bring the account current, it wasn't enough to bring it under the credit limit, which means they continue to charge me the $39 fee every month.

Due to financial hardship, I tried to make multiple arrangements with Capital One while still trying to make a payment in any amount I could. I got nowhere with Capital One as they tried to arrange $200 payments a month to pay off the debt ($900) when I could not make a $40 payment. We have an extremely limited income right now and I have done the best I can. They would not budge in the least but kept on accruing interest galore. I even made an offer to them about another payment option they could consider and would be beneficial to both of us but to no avail. One representative even hung up on me when I tried to negotiate.
Finally, the hardship department called me back in October and told me they took my account out of collections (didn't even know) and if I made a $22 payment still in October and then $40 during the next few months, I would be on track again and up-to-date. So, I sent them $22 in October and just got a letter from them (November) saying that they understand my situation, appreciate me making the effort to try and make payments but I was now too delinquent and the account was now charged off; my credit marked as extremely bad (the worst there could be, I think they said) and my account would still accrue 19.9% annually.
I do all communications in writing now as I do not think this is a credible institution. In the past, I have sent payments on time and was charged a late fee because they said it didn't get there in time and I had no proof that it got there on time. I will continue sending the amounts I can send. I have not received a written confirmation of a payment arrangement nor have I received a balance statement for any payment I sent in the past.

About two weeks ago, I called Capital One with the intention to come to an agreement and close my account. At the time, my balance was a bit over $1,000 but they were charging enormous amounts for late fee and over the limit credit. I told the representative that I was going to be able to be making the payments anymore and that I offered to pay $500 to get my account closed. The representative said that he wasn't able to close my account if I paid the $500 but that he can do it if I pay $660. I asked the representative to send me a confirmation over e-mail to make sure that was going to be done but he said that I would receive a letter in the mail where it would said that my account was closed.
Last week, I received a letter saying: Congratulations on accepting Capital One's fee credit offer. Your count will be credited for $100, as discussed during our phone conversation. In exchange for this credit, you have agreed to the following payment schedule $660." First, I was never told that the payment would only give me a credit of $100. I was told that it would close my account; otherwise, I wouldn't have made that payment. After receiving the notice, I contacted Capital One, and told them about what had happened, and all they could say was, "I'm sorry, there was a miscommunication. The most we could offer is a $100 credit towards your account." This is very upsetting and companies like this show how little ethics they have.

I received a "pre-approved" credit card from Capital One. I activated that card and was told that all was well and that I could use my card. However, when I tried to use my card, it was rejected, causing me great embarrassment! I called Capital One, and they said that I need to send in additional documentation in order to process my account. I can understand needing this documentation before the account is opened, and I don't have a problem with this. However, because of the very embarrassing situation, I was frustrated and requested that my account be neutralized, seeing it was obviously never really opened. I was informed that it showed up on my credit report as a canceled account, which would adversely affect my credit rating! How could this be? Obviously the account had never been officially opened or activated, because I needed additional documentation. So if it could never be opened, how could it be closed?

I am another one of the many consumers with excellent credit that had my APR go from 7.9% to 22.00%. I did not receive notification and therefore missed out on the opt-out option. I paid $6,000 off in two months, so that I could be completely done with this unscrupulous company. I did not have time to change my automatic health insurance premium, and therefore, I was charged interest again! That's even though I had paid the entire balance the month before. Ugh! I have had it with this company. Their practices are usurious, and their greed is out of control.

We have been Capital One customers for a while now and have a $15,000+ credit limit. Last month, we paid off all our credit cards including this one. I called to find out what the payoff balance was and they told me the same amount as in the statement. I immediately submitted payment and considered it one credit card paid off!
Today, I was opening mail and filing as necessary when I came across their last statement. I opened it knowing it was paid off and to my surprise, there was a finance charge of $106.73! I immediately called customer service since the bill was due today and this is pretty much what it boiled down to. I nicely asked them to waive that charge and he insisted he can only waive $10. I tried negotiating half way and once again he offered the $10. By now, I told him how disappointed I was and if the issue was not resolved, I would gladly pay the fee and close the account to which he responded, "Your balance is..." and I can close the account after the payment clears! Wow, I am not to react when overly upset (you would have never guessed by the calm tone of my voice) but I truly was upset. I told him I would call back.
Just a little while ago, I called back and by now, I was also being assessed a late fee of $15 (which they nicely waived)! Still keeping my cool, I spoke to the account manager who also offered to close the account since they can't negotiate on finance charges! So, I am paid off and closed off with Capital One! Warning: If you are about to pay off credit card, when you call for your pay off balance, ask the name of the person giving you info and write it down in a secure place! Capital One has no record of me calling and that is the reason they have for not waiving the charge! Goodbye, Capital One! One less headache in my life!

I requested a "special finance rate" of 3.99 percent to pay off a Wells Fargo auto loan from Capital One. The total requested was $7,143.00. The agent I spoke to ended up charging me twice. So now, Capital One says I owe them over $14,000 and they only paid the $7,143.00 to Wells Fargo. I have made phone calls, written a dispute letter and mailed via US certified mail, and sent faxes. No one will help me.
This charge is still on my account. It has been less than 30 days, but when I call them, I usually can't understand the person on the other end and they don't seem to understand what I am saying. They informed me that I am "over my limit" and "Would I like to make a payment?" I did manage to navigate my way up 2 levels on the telephone, and the farther up I got, the clearer the English became. But I have only received lip service and no one to help me.
I got a response from Capital One from the dispute letter I sent today. It told me that they were thanking me for checking on "finance charges"! Say what? I keep sending e-mail messages through my account, and the response I get must always be an electronic brain response as they never address the fact that I am disputing a charge made by them, the vendor. It's just a thank you for my being a customer. Say again. What? I have had a Capital One account for over 10 years, never late in paying and usually paying the entire balance off. If I ever get this straight, I will find the money some way to pay them off. And I will never ever do business with them again!
