In early July 2011, my social security number, birth date and other identity information was stolen from my employer. When I learned of this, around July 20 2011, I checked my credit report and made phone calls to the companies who had made inquiries of my credit based on fraudulent applications. I called Capital One about one such inquiry around July 22, 2011. The representative I spoke with assured me that he could not find a new application. But he would note in my file that my identity had been stolen and that they should not grant credit to any applicants using my personal information.
On August 14, I received an alert from Equifax that a new account had been opened at Capital One under my name. When I called the fraud department, I was told that they were unable to close my account, because the address information I provided did not match the information they had for the new account. I explained that my identity had been stolen. And that the reason the address did not match was that someone had been using an address different from mine to apply for credit. I reiterated that I had spoken with someone in mid July to inform them of the potential fraud. And I had been reassured that the problem was taken care of. The woman I spoke with on August 13th informed me that they had sent me information. If I did not have it, she could not help me (the information was presumably sent to the address of the identity thief). I am aghast and appalled at the lack of responsiveness to clear fraud. I hope that this can be resolved soon.

They are harassing me. I receive phone calls 3-5 times daily. They are looking for a Patricia. The calls have been going on since I purchased this phone on 08-11-11. Each time I have called back, the supervisors and agents that answer have assured me that the number would be removed. Then an hour later, I get another call and the process continues. I am tired of these calls. If they do not stop, I will seek attorney representation for harassment.

I received a credit card with a 300 dollar limit. I needed this card for the sole and timely purpose of purchasing a plane ticket back to NY to see my doctor for a medical emergency. I received the card in time to make the purchase but when I attempted to use it, Capital One said that they need more information from me. So not being able to use the card, I closed it which I thought was an already non-existing account with Capital One. Steve, the gentlemen who I spoke with over the phone, said "not a problem Mr. ** we will close your account and send to the credit bureau that you are all paid in full". I have not used the card AT ALL. I returned back to California from NY and to my surprise, I saw a bill on my mail box saying that not only do I owe Capital One $39.38, but my payment is late. I am rating my experience one star for being the worst experience.

To begin, this is the second time in the last year that this has happened to me. I tried to purchase airline tickets using my Capital One card and was denied. This caused me to purchase them using a different card that I am trying to pay down.
The first time it all ended with my account being "activated" (it already was), and a measly $25 credit was put on my account. This time I had to have the account activated. When I finally spoke to a representative on the phone (Mumchaz in Canada), I was told that nothing could be done and that she was the absolute highest authority I could speak with. She was not nasty, but not nice either.

We have been making payments on an account for the past four months but just recently, I got a threatening phone call from Capitol One that my payments have been coming back NSF and that they are starting the repo process. I then stated that my bank never sent me an email nor regular mail stating that they came back. Once I got a hold of the bank they told me all they have been doing is checking to see how much I have on the account and not taking the money.
After that I called Capital One again, I got no one. They called me back after a short while asking for a debit card because the said they couldn't take a check payment. I said that I don't want to and that I am willing to send them cash. But they insisted on getting my debit card information. I thought something is wrong. I explained to them what the bank said, then they changed the story by saying that I stopped payment which I never did. They are calling me all hours and the morning starting 7:30am until a little past 9pm. They are just leaving messages and not trying to resolve the issue, they just want to repossess the car. I only have one year and a couple of months left to pay in this car off, it is unfair. They are also charging me a lot of fees. What can I do? They shouldn't be able to get away with this.

I went to the bank to pay my bill. I am recently unemployed. While I was in the bank I received a call from a company that wanted me to fax over my resume, ASAP.
I asked an employee of the bank if they would fax this resume and she told me to talk to the manager. I spoke to Malena ** and she told me she wouldn't do it. She said she would lose her job if she did it. There were many things I wanted to do with Capitol One after I got a job, like opening up a checking and savings account, having my paycheck directly deposited, also maybe refinancing my home. Ms. ** is very unprofessional. I don't think that's the way to treat customers.

I had a Capital One credit card account with a $2,300 credit limit and was never late on payments always and I kept my account in good standing.
My card got lost last year while I was out of town and there were many unauthorized charges posted to my account which exceeded by credit limit. Capital One would not take care of any of the charges that were made to my card by the unknown person. When I refused to pay the charges, Capital One then turned my account over to collection agencies and they were harassing me ever since. That company is a joke, so please be careful because they succeeded in ruining my good name and credit.

Back in the winter of 2005/2006, my husband and I were in the process of buying our first home. And in order to get our loan, we had to pay off some of our small debt. We decided that since we hardly ever used our Capital One credit cards, that we together would pay them off and close out the accounts.
Later, after we got the loan and had paid off and canceled the credit cards, Capital One sent another billing. We promptly contacted them and told them that the cards had been canceled and paid off in full. The person we talked to said not to worry about it and it must have been a computer issue.
They stated that they took care of it but 6 months to a year later, we received a letter from a collection company stating that we owed money to Capital One. Again we contacted them and explained the situation that they were paid off in full and canceled.
They then started calling us. When our children would answer, they would tell them that if their loser parents didn’t pay the bill, they would take away all their stuff and they wouldn’t have a place to live. The one time when I talked to a lady, trying to explain the situation in a very calm way, she became very, very belligerent and started yelling at me. My husband took the phone and told her if she didn’t settle down, he was going to terminate the call. He then told her that we wanted proof, such as receipts, signatures and statements, that we owed the money and that we had that right.
We never heard from that company again. I called Capital One credit card again and they had no records of us even being customers! A few months later, another collection company sent us a bill stating that we owed the money to Capital One credit card. Yet again, we explained the situation and they had their attorney contact us because they were going to sue us for the money.
Their attorney called me and she stated, "Capital One has no proof of you even being customers and no way to prove that you owe them money. Consider this a dead billing. Companies like Capital One just keep selling their possible accounts that are behind or show money owed on a closed account to multiple collection companies in hopes that they can collect on them."
So, we did just that and considered it dead. Now almost 3 years later, Asset Acceptance LLC, assignee of Capital One Bank, NA, sent us another bill stating that we still owe money to Capital One. We again contacted them and they wanted proof that we paid them. It was explained to them that there is no proof from us or Capital One. The whole story was explained to them and the lady that we spoke to said, “Well I will give you a few days to look in your files and see if you have anything, otherwise we are going to send this case on.”
Which, of course, they did. They sent it on to Rausch, Strum, Israel Enerson and Hornik LLC, a group of collection agents and lawyers requesting and filing a lawsuit against us. We explained the situation to them. However, they are not willing to work with us to resolve the issue unless we are willing to pay Capital One $1,287.57.
But our billing statement was never higher than $500.00 at any point. Both credit cards that we had with Capital One where below $500.00 limit. This is a complete outrage that Capital One treats its "valued" customers this way and that they are allowed to do this to hard working honest people. We are not sure, short of spending money on a lawyer, on what to do. And why should we pay a bill way more than the original amount that we had already paid off?
This seems like a big scam and somebody is getting rich off of the little guy here. It’s sad how they keep selling their customers’ bills off to all these different collection companies.
Any suggestions would be greatly appreciated. Also we are contacting Capital One again today, 08/05/2011, and requesting the proof and documenting our conversation with them for the court date.

My APR was increased from 12.90% to 17.99% starting on my March 2011 statement. I never received any information or a notice that this was going to happen. I was not given the option to opt out. I called last month, concerned about this increase and was told that it had increased a couple years ago. I was dumbfounded but had to go gather my statements to see, when in fact it truly had increased. I called again today and asked for a reason. Julie said, "I can see you have been a member since 2007 and you pay your bills on time. But due to the economy, we as a business had to make a decision and increase the interest rates. I can not do anything for you at this time."
I said, "A 5% increase is insane. I purchased (borrowed the money) at a 12.90% rate when the economy was such, not now when you decide the economy calls for 17.99%". She, of course, fully understood my situation but could do nothing for me. I said I did not receive an OPT out letter and she said I probably just didn't notice it with the small print blah blah. I said if I had received it, I would have opted out because I can not afford this increase. It's insane.

Me and my husband are on a payment plan with them and they call daily, not just once, but almost every hour to an hour and a half every day. I can time them, whether we tell them to check their records or not, and we are told, “Oh, yes we see that. Thank you.”
The emotional stress this causes daily is now too much. The constant harassment because of this is now out of control.

I don't know why but for the past 9 months we have not gotten any statements from Captial One. We have several credit cards, car payments, etc and to have to keep track of what you get and don't get is a hassle. Capital One finally sent me something saying they didn't get a payment for 2 months and since not getting any statements I forgot. I called them and paid to get my account current requesting statements in the mail. I then put a reminder in my phone to make the payment by a certain day every month since I couldn't count on Capital One to send me monthly statements. I continued to call in and make payments over the phone for the next several months and this was becoming a hassle. Each month I called to make a payment I again requested a paper statement. Probably 7 times I requested by this point. I then requested new cards thinking that may get me better communication from them but also I decided to start paying online through my bank acct. The last call I made to them for a payment I asked them what my minimum amount was. The rep (can't remember the name) told me $75 since the card only had $5000. I figured as long as I made at least a $100 payment every month I should be fine. The last 2 months, I made a $100 payment and a $150 payment.
I thought I finally had a solution to the problem since I was still not getting any paper statements in the mail. My husband and I got a piece of mail from a collection agency yesterday (7/30/11) in reference to Capital One. Of course my husband yelled at me accusing me of not paying the bills. I then pulled up the bank acct and wrote down the dates and amounts of payments to Capital One thinking maybe a wrong department was receiving our payments. My husband called them with the information and it was then that they told me we needed to make a payment of $242 to get our account current and that we were not meeting the minimum payments the last 2 months (even though I sent $100 and $150). We made the payment and again requested a paper statement and my husband did not ask what our minimum payment is. So I am very confused with this credit card company in what my minimum payment is an why they cannot send a customer a paper statement when we have asked them about 8 or 9 times now. Maybe this is Capital Ones' way of keeping customers confused as to add additional charges to their accounts.
I have never been so frustrated with a credit card company and I am 41 years old. This is the card I am going to pay off first when I get a chance and I will NEVER get a card with them again. They have started numerous arguments with me and my husband not to mention that is hurts your credit when they send a collection agency after you even when you make payments and they have your phone number and address and they decide not to call you or send you any communication. If there is a lawsuit on this company I want in.

I am so tired of not being able to answer my phone because I don't want to talk to a Capital One representative. I'm not sure what part of "I have paid you as much as I can" they didn't get.
Every month I make a payment. When I do answer and explain all these and even make an offer to pay more than I can actually afford, like $50, they say, "Well we understand, but if you pay at least $200 will credit you account an extra $35 and you will be current."
If I just told them I can barely scrape together the $50, where the heck do they think I'm going to get the $200?! All I owe is $900.
They are bullies and I hate having to screen my calls. They have now started to call me seven days a week from 07:30 CT to as late as 23:00 CT. I have even had calls at 02:00 CT. Now they call almost every 53 minutes. When I have answered, it is an automated call saying "please hold" then hangs up. When I call back, I get a message, "Mail box is full". The latest has been a number of telephone from other areas all linked back to Capital One. The other numbers are 8132027244, 8663810453, 800955660, 8132741837, 8772684294.
Please help. What else can I do?

I got behind in payments; lost my job and I called in April 2011 to make payment arrangements on two cards. The one card is now usable (according to Capital One), and the second after making all the payments as arranged has now been put on permanent restriction.
I paid a lot of money to the card, and was lied to on numerous occasions that the card would be released from the restriction once payment was made. I spoke with Gwen (the supervisor) today, 7-26-11. She advised the card would still not be released. When I got upset and pushed the issue, she finally said the card was on permanent restriction.

I paid off this credit card and closed it. They would not let me close the card! They said they needed my address, social security number, mother's maiden name, all information that was submitted. They keep making up fake charges and wanting to collect money for nothing. I told them over the phone that I had paid the card off and that any further charges are not from any purchases but just for their profit.
They constantly call me and think I will give them money for no reason.

Capital One sued my daughter (in New Orleans) for $23,000 on an unpaid credit card bill of $1,400. The summons server sympathized when it was served, saying he was delivering them all over New Orleans. The reason is it skips small claims, and it goes directly to a higher court. The collecting attorneys told her that she could pay almost $3,000, over two installments to stay out of court. The person on the phone told her to bring in an amount less than half for the first installment.
When she arrived, she was told the person "made a mistake"; she'd have to pay half the money on the spot, which she of course did not have. She is on disability, and had to borrow from family. They insisted on automatically deducting it from her account. They got her routing number and account number. They refused to give her anything in writing about the amount, type of payment—nothing. They said,” we will mail it to you.”
Can they be trusted or believed not to grab any money that goes into that account from now on, up to whatever they feel like taking? The reason, by the way, her card went on default is she was late for a $40 a month payment due to a bout of extreme illness, and it immediately jumped to almost six times the original payment, $220 a month. For someone on disability, this is an impossible amount to pay. Capital One's tactics are underhanded and predatory. Can anyone explain how they can get away with this, please?

I had a transaction with a merchant and a refund was credited back to my Capital One account on October 2009, which was closed at the time the refund was applied. I contacted Capital One and followed all the process required and till date, my money has not be returned back to me. I have all the documentation involved with this refund request since 2009. The issue is that the merchant cannot reverse this charge in order to re-issue an alternate refund and Capital One has kept the money, which is illegal.

Capital One received full payment for the balance of my account with my written and signed letter (forwarded by my credit union.) They immediately cashed the check, but didn't close my account. I emailed them a couple of weeks later to tell them they still need to close my account, referencing the letter they received weeks earlier. The email reply I received ordered me to phone them, which I won't do simply because a phone call doesn't protect my legal rights.
Two more weeks later, I received an envelope from them containing a new credit card. I haven't opened the envelope and plan to return it (signature required) unopened, with yet another letter asking them to close the account. Closing this account was a condition of the increased credit limit and improved terms with my credit union. And, I agreed to close the account because they had just suddenly and without reason, doubled the interest rate they were charging me. Also, one of my credit reports all of a sudden states that having any account with Capital One (a finance agency) adversely affects my credit score.

I applied for my first Capital One card in 1994. After having it for four years, I paid it off and closed my account because of high fees.
In 2011, I decided to give them another chance and applied for a new card. I was approved for a new card with a $300 limit. Weeks later, I received my card and activated it over the phone. My first transaction was at my neighborhood gas station that totaled $13.05. It was declined. First, I thought that I did not properly activate it, so I called customer service. They stated that due to suspicious purchases, the card was put on hold (remember, the very first attempted transaction was at the gas station and it was declined). There was no previous activity. It was a new card that I had received the day before. I was told that I needed to send in sensitive information (driver's license, utility bill, check stub, passport, etc.) to make sure I am who I say I am and that I have the card in my possession. (HUH??)
I have never had a credit card company verify information twice (before and after extending credit (not even previously when I had my old Capital One card). I felt emotionally distressed by this. What is to become of the copies of my sensitive documents that I faxed to them that display my address, SSN, and income? I felt it makes more sense to verify all information BEFORE extending credit instead of having a customer make a purchase and then surprise them with a decline on a brand new card. That made me feel abused by my own credit card company and it is not a way to begin a relationship in business. If I have an extended history with this company, they should have a record of this on file. To harass a customer before they even do anything wrong is an abusive business practice.This practice is obviously suspicious and it needs to be mandated to change.

I had payment protection waiver with my Capital One account, I lost my job and they will not honor it. I am unemployed, receive no child support and am struggling to start a new business. I have offered to settle with Capital One's lawyers, but they are unwilling. They are suing me in Hingham District Court and the first court date is July 28, 2011. I'm scrambling to find a free attorney. They're suing me for all fees that have built-up over the years the I've been trying to get them to honor our original agreement. HELP ME!!!

I authorized a payment for $28.00 and between yesterday (it showed correctly yesterday) and today, it has "magically" changed to being a payment they will deduct from my checking account for the entire balance of $695.25! I am in my 3rd and final phase of their "re-age" program, which is a 3-step process to make my account current again. I am struggling. There is no way I can pay $695.25 and the overdraft fee that will occur as a result of them debiting my bank account for money that is not there. When I call them, they say it "is a process" to credit me back and it will take 7 days, and they are not concerned.
I am a single mother of 1, who has only $100 for the next 3 weeks. When I try to appeal to them that I cannot afford to "lend" my $100 to overdraft fees and such until Capital One will refund me, it falls on deaf ears. They are not at all interested in correcting their error with any urgency, and have hung up on me through the last 1/2 hour to different times, rather than fixing the glitch in their system. The payment on my other account with Capital One, authorized at the same time, is processing normally which should also show them my intention.

First of all, I always pay my credit card bill on time, every month; and I expect the bill to come every month, so that I won't accrue late charges or fees. Capital One doesn't send their bills on time; and they charge late fees for not sending in payments on time. This means that they charge us late fees for the mistake they made by not sending out the bill on time. I called three times already (even more in the past years since I started using this credit card), and I talked to the manager; and they never gave a valid excuse for not having sent their bills. The first time I called this month (6/19), a man named Marcel claimed that the bill went out and that the bill would arrive by end of June; so I believed him.
The second time I called (6/30), a man named Louis claimed that the bill was on its way and that if Capital One did charge me a late fee, I should call back to explain; I again believed him. The third time I called (7/6), I finally had enough and I talked to the manager named Michael (Capital One ID # **). He never promised me the bill would go out because he didn't want to take responsibility for what had happened. He claimed it was my post office that didn't get their bills to my address, and that I may have overlooked the Capital One bill. I lived in the same home for 20 years; and I verified my address with Capital One. I also check my mail thoroughly, everyday.
My post office never sends any other bill late. So whose fault is it? Capital One needs to take responsibility for its American customers. They never apologized or took responsibility for their own actions. Also, they have people in the Philippines (not the US), who poorly manage these customer service calls so that nobody (in the Philippines or the US) would assume responsibility for the mistakes made by Capital One. Please do not use Capital One credit card. They are unreliable and irresponsible. I wonder who runs this credit card company.
I'm sure they wouldn't want the same thing happening to them. They will charge you late fees for the mistakes they made; and they will not assume responsibility, as they hand it over to people outside the United States to take care of customer service complaints. Even the people who work for Capital One outside of the United States don't assume any responsibility. Nobody at Capital One assumes any responsibility. I'm sick of calling Capital One. I will never use Capital One again.

After 4 years of making payments on my Capital One credit card I was involved in a car accident and had no income. I advised Capital One of my situation and they wanted my credit card account paid off in full. They did not want to negotiate any further payments and turned me over to their collection lawyers who are Bleier and Cox attorneys. I made arrangements with the attorneys to make monthly payment which I have been doing for 6 years faithfully. When we made this agreement they stated they would not file a judgment against me as long as I continued making payments. Within a months time they filed a judgment anyway.
I still continue to make payments even though they increased amount. I noticed after making payments for 5 years the balance was going up. I initially owed them $3,800 and it is now up to $5,100.00 even with my payments they received. I have written them numerous times to try and settle and they refuse acknowledging that they have received my letters which I sent certified mail, return receipt which Idid receive confirmation of delivery. They refuse to talk to me unless I call them. They will not negoitiate. As of today July 5, 2011. I received and writ of levy which they attached to my savings account for the full amount of my savings. This money is used to pay bills, buy food and support myself. I use the account to accrue funds needed over and beyond my Social Security which is not enough to live off of.
I had no prior notice of this levy by phone, or mail or email that this was going to happen. I found out when I went to the bank and then the post office to find the levy in my mail box. I can't find anyone to help me resolve this matter yet they continue to abuse their rights as a debt collector.I did speak to an attorney and they stated that debt collectors were not allowed to levy an account without a summons to court first. I don't know what to do since they already took all my money.

The state of Virginia placed a tax levy on my bank account. The state made a mistake on my taxes due and found there were no discrepancies in my taxes for that year in question (2007) and faxed a tax levy lift to the bank.
On the 23rd (twice) and on the 28th, Capital One placed that levy on my account after hours of failed attempts to get Capital One to understand that the levy had been lifted. After at least a dozen of calls between the state and Capital One, I was finally able to get the lift order approved thru the bank.
Now, the bank has accessed a 100-dollar fee against my account for the transaction. I am currently working with Capital One to get a reimbursement of that $100 but I've been told by my branch manager that those fees are never reversed and she refused (as did many others I called ) to reverse the fee.
I felt that because of no fault of my own, I have been penalized by this bank. To me, that's like being accused of a crime that was never committed. I don't hold the state responsible for what has happened simply because the state had improper documents that I had filed with the federal government. I had an amended tax form (1040x) in which I had re-sent that tax year. The state only saw the original tax and based my back taxes on that document after obtaining a transcript of the real taxes due and paid for that year. I forwarded the documents to the state and they successfully completed my tax bill without any further due cost or any additional charges and gave me a zero balance due for that tax year.
Now having said that, they had sent the tax levy on 6/20 (I also received a copy from the state ) and on the 23rd of June, the lift was faxed to the same bank. On the 28th, the bank placed that same levy on my bank account. I called the state in which they faxed a third copy to get the lift off my account--which did occur. They claimed (in one of my many conversations) that because the lift order was placed before the actual lien was placed on the account , they refused to honor the lift order and that's when I had to get the third fax sent from the state. Fortunately, I was able to save the almost $3000 from disappearing from my account, which may have taken weeks, even months to get back. But now the issue is the $100 fee accessed. Yesterday (1st of July), I received a copy from the bank that there was a tax levy on my account. That levy was supposed to take place on the 5th of July .

This company allowed charges that were brought to their attention as fraudulent to stand. The charges in question put my account over the credit limit that was set and instead of challenge them and/or dis-allow them they just raised the limit and allowed the charges to stand. After being alerted to the situation they did not take any information that I provided into account when making a decision to let the fraudulent charges stand. Capital One is a joke.
Several charges to my account that shouldn't have been allowed in the first place and when discovered should have been reversed and credited back. But instead, we're allowed to stand and push my account total over the credit limit.

I was behind on payments due to job layoff. I notified them that I would pay as soon as I got my job in 3 months. They ignored my letters, then turned me over to their lawyer, who filed a lien on my house for $3000. It has brought me just stress and ruined credit.
The Attorney forgot to notify me of court obligations, so I got thrown out, and had to refile. By that time, I was making payments. What's in your wallet? Never Capital One again.

I got behind on my credit card last September after losing my job, having hours cut at another job. I contacted capitol one with no help. I ended up getting behind them in Sept. 2010. I made an agreement with them over the phone that if I paid them $170.00 a month for 6 months. I would be reinstated with my credit card. Not that I wanted to use them, but I'm trying to rebuild my credit. Capital One is now denying any agreement ever took place. I didn't know they should have sent me something in writing. I just made the payments, like I agreed.
I did everything right on my part, and now they are closing all my accounts that I haven't been late on, and the one I made agreements on. They lied, and there's nothing I can do, but let them harm my credit some more, not that I need that. Capital One will not provide me with any of the phone conversations we had, they will not provide me with any documents pertaining to the reasons my account was closed. In these times, they should welcome people who want to pay their bill, and not take the easy way out, and file bankruptcy. This is wrong, and I will continue to fight back. My credit is being ruined, and I'm still making payments.

On 06/13/2011, I was sent a Capital One bill with my name on it, but not my account. The amount due is overdue, $2,830.90 for account ** . This is not any of my accounts. I have 3 and all are paid, and at this time nothing is due. I have never been sent any information about this account. I have never been sent monthly statements. I have the 3 and only 3 accounts.

In 2006, I obtained a Capital One credit card in Arizona with a $2,000.00 limit and signed up for payment protection. I have never run up the card and always paid on time to build my credit after a divorce in 2003. In October of 2008, I was part of a massive lay off and was not able to find work. I alerted Capital One of my dilemma and they said I owed the money on the card regardless of my situation. The payment protection agreement states they were to help pay off the debt in case of sickness, job loss or death. They did not want to honor it.
Consequently, I have lost everything at the age of 52. I have lost my car, I have not a home to speak of, no assets, I sold my furniture in exchange for food and shelter. I have been homeless twice, my credit is destroyed by credit card companies like Capital One. I rent a room at this address and the owner of this home is helping me so I can have a place to stay.
I am now being sued by Capital One. The attorney is Andrew ** and the Case No. ** and I have nothing to pay this debt with since it has almost tripled in fees, interest and more interest from $688.00 to $1916.00 not including $750.00 on attorney fees despite all the begging and pleading I have done to get them to stop and honor the payment protection insurance I had paid them for almost 3 years. My credit is destroyed and I cannot get a job because of it, plus no transportation and a degree in Finance, I live like a pauper. Please help me.

A former employee used my card for 11 months before we discovered it. We received a phone call from Capital One leaving a message and telling the office it was a civil matter and left us hanging on the crap statement of not being responsible. I have asked for documentation of such a policy and they won't even return my calls over the past 6 months.

What I am about to describe will speak volumes to the integrity of Capital One. On April 9th, I payed off my credit card and closed my account. On April 10th, I phoned to check my balance and it was zero dollars and zero cents. On April 21st, I received a bill for 82 dollars. I called to dispute the charge and two employees insist I must pay. I mail a check for 82 dollars and 26 cents the next morning.
On May 21st, I received a statement that I have a credit of 82 dollars and 28 cents. I called to hear I will receive a check in three to five days. After a week, I did not receive my check so I called to hear it will be sixty to ninety days! After another week, I called to speak with the highest ranking employee possible. That was Jason ID# DNV961. Evidently there was no urgency on their part to return my money. He said he would draft the check then and I will receive it in three to five days. That was yesterday and I'm sure it's on it's way. It shouldn't have come to that!

I used one of those 0% APR checks. The deal (3% balance transfer fee for 12 months) seemed like a good deal. I wrote the check for $15,000 and it showed on my Capital One statement on March 28th. While the minimum payment was $160 a month and the due date was the 23rd of the month, I paid two weeks early and $200 a month rather than $160. I just didn't want any mistakes that would increase my rate from 0% to 17%. I set up automatic payment on my online banking account. I started paying $200 in early April and in early May. My statements looked good. It seemed like this was actually going to work for me, but then, I got an alert from my Mint account that I had a just gotten a finance charge from Capital One of almost $300.
I called Capital One immediately. First, I spoke with a guy who I later realized knew exactly what was going on but wasn't going to be the one to "manage me". He was nice. I didn't mind that he seemed to have no access to any of my account information and that he had to ask me for everything. He said he understood what had happened. He agreed that I was not late on any of my payments. He gave me comfort that this would be resolved right there and then on the phone. As I waited to be connected to a "senior" something, I asked my service representative if he understood why I was upset. He did. I asked him if many others called. "Many" he said.
I was finally put through to the senior representative who couldn't have been older than 22. She said that she wasn't quite sure why the interest rate had been increased but it was possible that I had "used the check" after its "use date". I asked her what the "use date" was on the check. She said that she could not tell me at this time. I asked if she could tell me at a later time or if someone else could tell me. She said, "No".
I asked her what recourse I have since I believed the check's expiration date was after the 28th of March (the date that it showed up on my capital one account). She said, "Find the original letter that came with the check." "Can you tell me when the check expired?" I asked again. She could not. "So, you are telling me that you are increasing my guaranteed rate but you are unable to tell me the date that the check expired," I said. "It is the computer that did it and it probably did it because you used the checks too late," she said. Her responses turned out to be those that you hear from someone that is well-trained by lawyers. "I am sorry that you are upset. I understand that you must find this frustrating."
Regardless of what I said, I got some line. She was a pro. She was not going to get rattled. She was going to repeat her few lines until I gave up. So, in the end, my rate was raised from a guaranteed 0% to 17% for a reason that they could not supply. So, here I sit. I can't find the original offer letter that they sent me. I have it but we are reconstructing our house and our papers are a mess. I have read other complaints on this board and what is clear to me is that I must pay the full balance a.s.a.p. in order to avoid other Capital One tricks.
I have not totally given up however. I happen to have next to me another one of those letters with checks for 0% APR. The use by date is clearly marked on the check so I have called Capital One and asked for a copy of my check. I am hopeful that it will arrive and then I will ask for a return of the interest. I'll still be out the 3% that I paid to Capital One for $15,000 at 0% for an additional 10 months ($450).
One thing I wondered as I look upon this second letter/check for 0% APR, it doesn't say on it anything about what happens if you try to use the check outside of the use by date. This probably isn't the strongest part of my argument but it seems to me that if you try to use any other special offer after the close date, then what happens is you just can't use it. I couldn't imagine any other company giving you the service but charging you some other rate without first confirming with you that you had missed the date for the special offer and this would likely cost you more. They had me on the phone to make sure I had been the one who wrote it so they certainly could have followed standard business practices had they chosen so. In the end, I'll tell everyone I know about Capital One.

I had an account with C.O. the last few years and then I was unemployed so I couldn't make payment at first. I got penalties and late charge and interest. I called and talked to them to explain the situation that I had at that moment but their representatives said they don't care what is my situation, as long as I don't pay, they will have the consequences against me even though I have the protection plan. After a couple of months of trying to keep up with the minimum payment, I couldn't take it anymore and I stopped making payments.
As this moment, with the original of about 500 dollars, it comes up to $2,300 and I don't even know why. To be honest, Capital One representatives are very rude and unhelpful. They never considered my situation at all.

I had an ongoing balance with them for over 5 years of $300. I was only paying the minimum due which was like putting money in a bucket with a hole in it. Towards the end of 2010, I was unable to pay anything on the balance, and late charges and interest began to accrue. In February after I received my tax return, I paid $300 towards the past due balance. I never heard from Capital One again. Then in March, I got a letter from IC Systems, which is a collection agency. They said that I owed them $521.00 for the Capital One debt. I told them I paid Capital One $300 over a month ago.
They said they never received the payment. I called Capital One and asked them what happened to my payment, and basically they said they didn't know which is absolute cow manure! My bank (SunTrust) states that Capital One received the $300, but Capital One made it seem as if my money went into the abyss. They had no way of retrieving it. In the meantime, the collection agency is sending me letters. Capital One won't help me. IC Systems won't help me. I'm a college student, and I don't have much money. I gave up $300 to attempt to put a significant dent in this debt.
Now, nobody seems to know what happened to it. The operator at IC Systems told me that Capital One was notorious for sending them accounts and not transferring the payments over to them. I've since paid IC Systems $107.90 towards that $520.00 balance. But in the mean time, my $300 is floating out there in the Universe. Technically, I've paid Capital One over 80% of what I owed them. Not sure what to do at this point. Help!

I had a card then lost my job. I had payment protection. They did not send me any information and put my account into collections. Now, I have a judgment against me and it's on my credit report, not to mention that it is making it almost impossible to get a car loan without an co-signer.

I accepted a Capital One credit card with APR of 0% for 6 months, until April 30, 2011 and thereafter, 12.9%. I received my May bill and the APR was 24.90%. I called customer service and spoke with Helen who transferred me to Freddie who transferred me to Gloria, as account manager. I explained my concern with the APR of 24.90% for purchases which is the same as for purchases. I have not used any cash, no late payment or over the limits. I was told to fax my complaint to the General Correspondence. I received letter stating that they could not reduce the APR as I requested.
I did not request to lower APR but to honor the agreement of 12.9% as stated on the disclosure agreement. I have been a long-time customer of Capital One and never thought of their unethical policies and procedures. I am unable to work and completely disabled due to medical history and surgeries. My only income is Social Security. I accepted the credit card online through an offer sent by Capital One. I trusted them and I will not use this card any longer or accept any other offer from Capital One.

Basically, I had a Capital One card and then I lost my job. So as you expect and already know, I got a million phone calls and letter in the mail about late fees. The debt got sold off to a law firm for now the law firm took me to court to recover the debt. I owe triple what I owed and feel like I shouldn't have to pay simply because when these people were harassing they never said that they offered credit card protection. As I explained to them, I lost my job; they never once said they had had the service and for this certain amount extra they would pay the minimum due and help keep my balance in good standing. So I already know why this is so but I want to know if I can take them for court for non-disclosure and get this off my credit summary.

I had a major car accident back in 2005 and had payment protection on my account. Capitol One refused my claim and refused to pay out my payment protection insurance. The account then went into default and I could not pay anything because I was not working and my children came first. They sent the account to a law firm and the law firm decided to take me to court in 2007.
I advised the law firm that I was in the hospital and sent them the proof and let them know that I was unable to be present during the hearing and asked if they would postpone so I can defend myself. No, they went anyway and then placed a lien against me and charged me $2500 for a $600 credit card. Then in July 2010,they sent a letter stating they were audited and they were responsible for all of the charges that built up do to their mistake. Yet they refuse to pay it and remove the lien.

I was paying more than the minimum payment for a while but the balance kept going up. After a while, since I am disabled, I was unable to pay. I was taken to court 3 times and finally won but they are still harassing me. I was finally able to reach the collections and explained that it was thrown out of court but they say they can't find the info. They still continued to send me letters, call and call, etc. What can I do about the harassment? This is still on my credit which I am trying to repair. Iit is causing me to worry and have panic attacks and I feel like I could pull the phone out of the wall and my mail box down. These people are killing me. I think they may have sold the debt to someone else by the number of different calls and letters I get but Ii am not sure. I am sure that it has to be them because I do not know who else it could be.

The company Capital One did change agreement to credit card. I was not informed in writing about the change. I am getting a five dollar a month fee and interest at the same time. I am busy person that works approximately 15 hrs a day. When I found out, I called the bank and spoke to supervisor named Pheinx who refused to take the five dollar a month fee away. I told them several times to that I was never informed about any changes. They refused to take away the credit card $5 a month fee. Please help, I never agreed to to this change.

My husband and I had Capital One cards. We ran into financial issues and the cards were closed. And we went through a debt consolidation company. We decided to stop the debt company and settle the accounts on our own, since the principal on the accounts were more than paid. We had a payment arrangement set up with Capital One until they pulled a payment out without authorization. Then, it had been a year of no response from Capital One or the companies they hired to handle the account. We finally got an actual person from these companies. We were spoken to in a rude manner and harassed. I was finally able to set up payment arrangements that would finalize the account. The final payment on my husband’s card was to be 4/30/11.
Then, the Sony theft happened and my credit card information was stolen (someone tried to charge $1800.00 on it but the bank was quick enough to stop it). But my card was closed and a new one was issued. This all happened between 4/29/11 and 5/4/11. I called the company to explain the situation and give them the new information so the last payment could go through. I had to fight with them because now they wanted another $50.00. This is not right. Someone stole my MasterCard and I had to spend a week trying to get everything straightened out. And Capital One wants to charge me another $50.00 and be rude and harassing at the same time.

They refused to give me credit because my son filed for bankruptcy and the credit reporting agencies put it on my report. Although he has the same name, I requested to all agencies last year to check the Social Security and DOB, but they still put it on my credit. Capitol One just refused me credit stating on the letter that there is a presence of bankruptcy or bankruptcy filing. This issue resulted to stress and a damage to credit.

I applied for a credit card after checking my credit score. My credit score is in the good to excellent category with no defaults in the past 10 years. I have 4 other credit cards, all paid off monthly and I have no debt. I was immediately denied a card. I called to ask why, was told I had to wait for a letter to know why. I explained I had good credit and would like an answer since I was immediately denied, there must be someone who knows why. I was told I would be transferred but was actually disconnected. I waited for the letter, the letter stated it was due to past delinquent payments. I have none, in fact, I used to have a Capital One auto loan in which I paid it off early. I still have no idea why I was denied.

I have had a Capital One account since 2000 and received notice a few months back that they were changing the terms of my account and increasing my interest rate from 7.9% to 17.9%. I have very good credit and pay on time, yet they decline to change my rate to anything lower. I call and email each statement and still no result. How is this good business or even ethical? Where is the justice? Citizens bail out banks in crisis only to push the working class further down.

I called to try and correct my past due balance and asked for a debt reduction amount. I was willing to do what I could do but was treated very rudely and was told that Capital One does not work with people like that. I have been a long time customer and am now being charged 27 percent interest because of some hardships I am having because of being unemployed and 2 back surgeries. I am very unhappy with your representatives. They have no compassion and are unwilling to listen. I am done with Capital One!

I have had an SBA loan through Capitol One for some time. The original amount was $50,000.00 and I have paid the loan down to $3800.00. Because my business failed, I fell behind in my payments . I have been making regular payments to pay down the account and eventually pay it in full. Tonight I received a call from Capitol One informing me that because my account was delinquent that it was being written off and an I-9 would be filed further ruining my credit rating. Though delinquent, I have been faithfully sending substantial payments monthly. Every month I receive a letter from Capitol One offering help with this loan in the form of modified payments but though I have asked they have always told me that no modification was available. I expected to have this account paid in full by summer.

Our interest rate went from 9.9% to 18% for no good reason. They did this at the time the government was bailing out Wall Street. Since we had some things that were on autopay, we didn't have the time to cancel the services and stop using the card and keep our 9.9% interest rate.

I went online to make my monthly payment to Capitol One and noticed that our payment was unusually high. I called Capitol One and asked them what was going on. They replied that they had raised our interest rate from 13% to 22%. I replied with, "We have never been late and we have never been over the limit." They asked if we had ever done a balance transfer; I said no. We have never had a balance transfer or used our card for cash advances. We keep our credit card in our sock drawer mainly. They put us on hold for a while, came back and stated due to the economy, they raised our rate. I told her I'd like to close our account and I was transferred to a manager. The manager told me that if we closed our account right now, we'd be stuck with the 22% and paying it off would take longer.
I was told that Capitol One had sent out notices in the mail about their rates and I told her I did not receive anything in the mail telling us that our rates would be changing. The only thing I received in the mail was back in December stating "We may increase APRs in existing and new balances if your account is 60 days or more past due.” It also stated that, "We are not increasing your current rates at this time.” So where is my documentation that states our rates ARE changing?
They offered to lower our rate to 18.99% and I told them that was still unacceptable and they made it sound like Capitol One was doing us a favor by lowering it to 18.99%. Really?! Are you kidding me? We have never been late, no balance transfers, no cash advances and we are paying it off in lump sums and why weren't we notified about our increasing rate? So the problem with this is, if I close this account, it will greatly impact my FICO score and I would be closing it at 18.99%. Our interest rate went up over 9% with Capitol One and without notice!

Capital One overdrew my credit limit by adding a $400.00 charge after the charge from Enterprise Car Rentals was declined. They took it off after I disputed since it was declined. But they let Enterprise put the $400.00 back onto my account which made the account over the limit--which meant over the limit fees and late fees. I have the paperwork that shows I didn't sign the car rental agreement. I would like the current lawyers who bought the account from Daniels Law firm to check my information and emails.
Also, my original balance was $500.00 which has morphed into $2,502.00 with additional lawyers' fees added from Daniels Law Firm to Lustig, Glaser & Wilson Law Firm. I have called them on 2/17/11 at 2:51PM and 3:00PM. I have asked to send me the information proving what my account balance was before the additional charge, but they refused. I have had this account since 2003 and never was late up until they added this $400--charged with the minimum payment going up every month. I got a card from Capital One in August 2005. I had an account with them for years. In December of 2005, they sent a bill to my 12-year old son for payment. I called them and explained that he didn't have a card--why would they send him a bill? I had always paid online, and never received a statement--only to find out that they had issued a card in my son's name. At first, they told me that he was the second card holder on the account and that I was the first. I asked them to take him off. Second, I never received a card in his name.
About two months later, they sent him a card. I called back again. They admitted error and said that they would correct the situation. It would take 7-14 days to correct. In the meantime, I kept the account open, as it had my name on the account online. Then, some time about a year later, they called to up the credit limit. It was now in my son's name, and mine was off. I talked to another CSR and taped the conversation. Same thing, they admitted that they were at fault, etc. She said that they were closing the card but I need to pay what was due.
Almost two years later, I got a collection letter in the mail in my son's name for Capital One. I called them again, taped the call, and spoke to a supervisor. I told them that I wanted a letter saying that the account was closed and that I would not make another payment on my $35K van that was financed with them until it was fixed. I got a letter via email, and thought all was good.
We are now in federal court for identity theft. Capital One says that the letter is not legitimate and that the account was not closed. They were claiming that I was never on the account, even though I have a copy of my card, which they say was never issued. Has anyone ever heard or seen such a problem--any documentation, etc.? If so, please email me. I would appreciate it and would gladly pay you for your time!

I have been a Capital One cardholder for over 6 years. I have never been late with a payment in the past. I called Capital One to inform them I could not make my minimum payment last month of $80. I was told they understood and as long as I made the payment along with the next payment for a minimum of $177 by next month's due date, they would credit the $39 fee involved with being late after the payment had been made. I thanked them and assured that I would call back when the payment had been made to get my $39 credit. The very next day and for the last 2 weeks, I have received 8 -10 calls per day starting at 8:30 AM - 9 PM, asking to make a over-the-phone payment.
If they had informed me originally that harassment calls were going to be made every hour until the payment was made, I would have made the payment and not eaten for the next week. In my opinion, this is a bad company to do business with and it is not the first problem I have had with Capital One. Fees, raised interest rates and other items have been added for no known reason which after numerous calls and time are always removed "as a courtesy".
The courtesy would be they do not try and get away with items such as these. There are people who do not check statements and such who never realize what is being added. I do check statements and complain when these types of fees are added. I am not naive to think that any credit card companies are any better. They all should be avoided at any cost, unfortunately sometimes they cannot. I know some who read this will think "deadbeat", but like I said tough choices have to be made during hard times.

In June 2006, I became disabled. I had several credit cards through Capitol One with which I paid credit protection. After months of trying to get proper applications to apply for my benefits, I finally gave up because it was taking a bigger toll on my health.
Now, four and a half years later, I have been contacted by Capitol One that they had not received my claim form. They sent me a claim form and I have filled it out with a copy of my letter of approval of my disability payments and statements from my doctors. I hope to hear from them soon.
I was harassed by Capitol One and I even pleaded with them, by letters, to give me time to get my disability payments started. On one occasion, I did have to sue to stop the harassment. I explained to them and even ask them to let me send them proof of my disability but they just said that it's a different department. I ended up ruining my credit because I could not pay my bills.

I was a Chevy Chase Mortgage customer (CCM) when it was taken over by Capital One Mortgage (COM). I was contacted by my previous loan officer Christopher ** and was told that I could refinance my CCM loan with COM and get a lower rate--as such, lower my payment and it would only cost me approximately $485.00. However, I could not have any money returned from the CCM loan and any money in my escrow account would be used toward the new loan.
What I found was that COM did not pay my homeowners insurance that was due prior to my old loan closing. They sent me a letter saying that I needed to pay my homeowners insurance for $1,200 or they would have to add it to my new mortgage which is now more expensive. When I called to ask about it, COM said the insurance was just not paid. They apparently kept the money in my escrow account for themselves instead of paying my insurances like they were supposed to.
I am now in the process of severing all banking relationships that I have with Capital One. I was a member of Chevy Chase Bank because I chose to be a member. Now, I am stuck with the shifty Capital One Bank for the next 22 months when I have recoup all of my loses doing this refinance.

Capital One small business credit card company has been taking fees for this protection for three months without my knowledge. When I called to activate the plan, due to unemployment, I was told that this was not a part of the plan. They would cover the payment for a natural disaster such as a flood, but not being unemployed. Due to unemployment, I have not been able to reduce this debt. That is a "rip off" to the consumer, not to mention the fact that Capital one signed me up for this without my knowledge. What kind of payment protection does not cover being out of work?

I am a credit card customer of Capital One for a long time now. They increased my credit limit last month to $2500 from $1500. I was happy and started using it more than I used to use before. I was using it and paying it right after using it. After a month, I went online and saw that my credit limit was decreased by $1500 again and the remaining balance on my account was $228. I was shocked with this nonsense. I called Capital One help desk and they apologized saying: "We are sorry, it is a mistake from us", "We apologize and sorry, we can't do anything" and all lame excuses.
Now let me tell you why they did that. They increased the limit so that people start using credit cards a lot and Capital One can earn money by giving this temporary, fake favor to customers. This is illegal and how can you do that with such courage and confidence? I was cheated, I need your help. I used so much of the card and paid huge interests on it and was happy. You can check my credit history that I am a great user of credit cards. I need justice. Please help as they will or may have cheated many people like that. This is insane. It can be anyone among us. Please take actions.

On November 30, 2009, at 11.10am, I spoke with Anita. I just called in to Capital One Bank to advise them of my issue at the time due to illness. I was still paying them $20 a month but I notice that my invoice charge had grown without any charges made by me. It was up to $420. Anita allowed me to speak then and she stated that she will do her best to help me. At that time, I was asked to hold on the line, which I did, and then I was informed by Anita to disregard the amount that it had been written off as debit forgiveness that there were several options under this plan and that I would not receive any future billing from Capital One Bank. I asked if she was sure that I was not expected that at all. Anita, Capital One Bank employee informed me that she was sure and if there was anything else and then ended the call.
As of today, I have not received any billing from Capital One Bank but today I received a letter from American Meditation (Tennessee) advising me of a Civil Suit has been filed named Capital One Bank vs. Kimberly **. All of my other creditors are being paid; why would I leave one out/omit unless I had been advised/informed to do so by Capital One Bank employee, Anita. I am really upset about the deceit of this company and employee.
This has to be put behind me. I am not sure what is going on. I have not spoken with Capital One Bank since November but this is bad business. Misinforming a consumer is unfair, and undermined. No fair treatment or intentions were intending by the Capital One Bank. I want this to be as I was informed as debit forgiveness - write off. In 2011, how it is that Capital One is still displaying negative credit reporting on my credit report. I really need some help hear! I was misinformed and misdirected apparently.

I have a Visa business card with Capital One Bank. Last May 2010, I purchased a camera, which made my account exceed beyond the credit limit. During my purchase, my card was not declined for spending beyond my credit limit. I understand I have to pay then for an over-the-limit fee, which I saw on the account statement of the same month. Today, much to my dismay and my wife’s, we just realized that we were paying $39.00 per month for over-the-limit fee up to now. I thought I only have to pay a one-time fee, as in the application you only see $39.00.
My wife and I called Capital One Bank Credit Department at 1800-887-8643 and spoke with their specialist, Jose with ID No. **, to dispute the monthly charge of $39.00, as it does not say in the application that I have to pay every month until I am not over my credit limit. Otherwise, I would not have gone beyond my credit limit. My business is so slow that I can't even pay my $827.26 excess in account. And after my wife was talking to Jose for several minutes (being put on hold on and off), he offered to waive one payment. But we argued that this is clearly deceiving customers, not telling us monthly over the limit fees until it is paid. This is beyond ridiculous. My wife’s blood pressure shot up just thinking and talking about it over the phone with him. Then after a while, he said he can waive 2 payments. But it is still ridiculous because I still have to pay the succeeding months until I won't be over the limit. If we had known this, we would not have used the credit card. Then I asked for the supervisor since Jose said that's the only thing he can do. I spoke with Cristina, ID No. **, who said the same thing. The disclosure did not clearly say to pay a monthly fee, otherwise, I would not have made it reach this point. This is making us harder and longer to pay our account and making us lose our business.

I use Capital One online banking. I have a month payment sent to Bank of America. Capital One sends a paper substitute check via US mail to Bank of America. They received the check and deposited. Check was endorsed by BA and copy electronically sent to Capital One for payment. Capital One released the funds. Funds never made it into the account at Bank of America. Bank of America (Customer Resolution department) indicated repeatedly that they can't do anything to find the funds or see where they incorrectly deposited the funds.
Capital One indicates the endorsed side of the substitute check is proof of payment and its BA responsibility. I believe one or both aren't adhering to the Check 21 Act of 2004 covering electronic transactions. Meanwhile the only solution provided by Capital One is to file a fraud charge against BA to reclaim my funds. This will take up to 120 days.

I noticed a balance due on my credit report from Capital One when I never had a card with them. I filed a dispute over three months ago and did not get anywhere. I called several times and with the account number listed on my report. They confirmed that there is no such account but they still are impacting my credit score. I spoke with several managers there and no one can help. I tried to file a complaint online on their site but because I do not have the code on the card, I cannot submit it online. I need help getting this fixed. Capital One is a dead end and the three credit bureaus can't help either.

Capital One Credit Cards claim that I owe them $3,025.33. I do not have a Capital One credit card and I do not know what they are talking about. I received an offer in the mail from Capital One inviting me to apply for a card. I responded to the offer and was granted a credit card. I called in and spend twenty minutes activating the card with someone who barely spoke English and was there to sell me additional products such as credit protection, identity protection and the like.
A day or two after activating my card, I went to the gas station and tried to use the card to fill my car but the card was declined. Thinking that it may have been a vendor issue, I simply paid cash and left. The next day, I tried to use the card for a store purchase but it was again declined. I called Capital One and they informed me that my account was suspended the instant I activated the card because they needed additional verification of the information I had provided at the time of application. They told me that I would need to send in a copy of my driver's license, a copy of a utility bill, a copy of my bank statement, and a copy of my pay stub. I asked why this information was not requested prior to issuing the credit line and card and they said that they are not required to verify anything in advance and that they have the right to suspend an account at any time, even if it is not late. I was furious and hung up.
I called back several hours later and explained the problem again. This time, I was told that my account was not frozen upon activation, but that something related to my first attempted transaction flagged my account as potential fraud and Capital One was just acting in my best interest by freezing the account. I asked why I was not notified that my account had suspected fraudulent activity and the representative said that they have too many customers to contact them individually about these concerns. I immediately cancelled the account and told them to remove my name from any communications lists.
Interestingly, when I was complaining about the experience, I had a friend tell me that she had gone through the same experience with Capital One. She applied for and was approved for a card, only to have it immediately frozen for potential fraud. She too could only lift the suspension by faxing in the required documents. This would appear to be a common business practice of this company.

I had a credit card with a $500 maximum. I got sick and the bill got behind. In February 2010, I got in touch with Capital Bank in Salt Lake City, Utah and told them that I would need to pay an extra $250 in interest on the $500 limit card which made a total of $750. They agreed and I put in motion for my bank to pay $50 each month until $750 is paid. When I made payments I made them out to Capital in Charlotte, NC. They got involved and messed everything up so I got back with Salt Lake City and they said to continue.
Yesterday I received a letter from Charlotte, NC trying to get back in the picture. I went back to my bank and stopped payments until I get recognition and not be disturbed by Charlotte. My bank said I only have ten (10) payments before this bill is paid off. I do not want Charlotte to interfere with me paying this debt off.

On 11/14/10, my car was repossessed by Falcon International at my home address, no keys requested or given. There were no keys for this car until Adessa made one upon the car’s arrival to Adessa on 11/24. On 11/24/10, the car was transported by Mazerall Towing to Adessa, Colorado Springs (car auction house).
On 11/26/10, I paid to have the car reinstated. On 11/29/10, the car was released to me by Adessa. I retrieved the car at approximately 11:30 AM from the security lot at Adessa. Using my own keys, not the one Adessa made upon arrival of my car on 11/24, I drove it around the corner towards the highway to take back to Denver when the car locked up and shut down. I was able to get it to the truck stop parking lot on my left. The oil light was on so I went inside the truck stop and purchased 2 quarts oil. I opened the hood, checked the oil and it wasn't registering any oil at all. I poured 2 quarts oil in and it still was reading no oil. I tried to turn the engine over and it would not start. I then sat in the car crying.
One of the truck stop mechanics came over and asked me what was wrong and then went and got his dad (manager of garage). They pushed my car into their garage and took a look at it. While pushing it into the garage, they noticed all the oil I had put in the car was now pooled in the parking space. After looking at the car, they told me I had a hole in my oil pan the size of a softball. I called Adessa back, specifically Charlotte and told her the problem. She sent a tow truck driver from Adessa to retrieve the car.
The manager of the mechanics, Dustin with phone number 719-491-3679, told me he would get the car repaired and contact me as soon as he got the part from a Chevy dealer and got it repaired. I also contacted Capital One this day and was told that they would send a damage claim affidavit to my email address. But I had not received that day.
On 12/1/10, I was told by Dustin at Adessa that my oil pan was repaired per Capital One’s request but the car was inoperable due to an engine knock (blown engine, rod thrown) and they were now waiting for Capital One to authorize the new repairs needed.
To this day Capital One has not authorized any more repairs to my car.
On 12/7/10, I called Adessa, Charolette, Dustin and Capital One. Not one progress on my car. I was told that Dick (phone number 800-227-3863), a manager at Capital One, would be returning my call. I received a call back from him during my son’s choir concert that afternoon. I returned his call that same day and left him a voice mail.
On 12/8/10, I called Dick at 2:49 PM and again left a message. I called Charlotte and she had not received any word from Capital One.
On 12/20/10, I called Capital One and spoke to reps Ally, Mo, Adrian and Michael. Michael’s manager, Cedric, got on the phone but I had to go to work at that point. At 4:30 PM, I was given a number for a reinstatements department and was told they were handling the situation with my car.
On 12/27/10, I called Capital One at 3:50 PM and was transferred at 4:04 OM to a department that rang sixteen times before I hang up. I called back and was told a floor manager, Christina, would call me back after forwarding my file to a RAM team. She never called back. I called customer service again and was told a Samantha, another floor manager, would call me back in 24 hours.
On 12/29/10, I received a call from Samantha. She stated another manager from the vehicle re-marketing department would be calling me back in 24 hours, as they have my file. That person never returned my call.
On 2/2/11, I left message for Samantha at Capital One. I called their customer service line to be told by an agent that the file was in collections and her manager refused to get on call and the agent then terminated the call. I called them again and spoke to Jeff in collections, who tried to get a call back for that manager again but stated that that manager can’t help me anyway as my file was in a department called special operations. He tried to transfer me to reinstatement department to no avail (call was dropped). I then called the reinstatement department directly. I spoke to Michael (same Michael from 12/20 call) and he stated my file is with vehicle remarketing but they are closed for the day. He gave me an ext. number for a Heather to use tomorrow when I call.

PayPal made a mistake and ran my payment through my bank account instead of my credit card. My Capital One account is set up in a way that they decline the payment when there aren't enough funds. Paypal's system automatically keeps trying to run the charge over and over before they try the credit card. Capital One charged me $35 for each time they had to decline the transaction, forcing me to pay hundreds of dollars for an item that I bought for $13.
I called Capital One when I had only 3 charges. The agent on the phone told me that it's a mistake on their side, and he's fixing it. When I warned him about how PayPal works and how they'll keep trying to charge my bank account, he said he will modify my account blocking those payments, so there wouldn't be any further charges.
Three days later, there were dozens and dozens of $35 charges on my account. I called Capital One in rage, and they said there's nothing they can do. They waived only $70, and they said the first person who opened my account didn't set the account properly. They also said the first agent I talked to informed me wrong. And he didn't have the authority to refund me those charges or he didn't modify the account to stop the following charges. He said this time he modified the account properly, so I wouldn't get any more charges.
Then he directed me to a supervisor to discuss further why I shouldn't be paying all those penalties, even if it's their fault. The supervisor told me that the agent I just talked to misinformed me again, and there isn't a way to block any future charges. If PayPal tries to run the payment again, I'd get more $35 penalty charges--which they did. He said there's nothing he can do and that I have to pay $35 for each time they reject a payment no matter what. He also said, "You take the risk when you give your account number and routing number to someone."
I'm closing my account and canceling my credit card on Capital One Bank. They are scavengers about these charges. When they legally can, they'll charge you with anything and tell you it's your problem. So you let them back you up on payments, and you pay $35 for overdraft charges. But your payment doesn't get rejected. That's understandable. Or you don't want that but they charge you $35 anyway for rejecting the payment. This is insane.
Bottom line is you have to keep a balance of a good $1000 at all times to avoid any problems. That's what they want. When a mistaken charge goes through, they reimburse you the charge but you pay the overdraft fee even if it's not your fault. I don't want to be a part of this scam, so do you.

I signed up for the payment protection paid on it for years then got into a motorcycle accident and then laid off from work. Knew I had enough in the program to cover balance but they never gave it to me. Now, after 2 years, my balance with them has doubled and I still get a bill every month with new charges.
My credit is at risk. They hassle me almost every hour with phone calls. I tried to do the right thing but they wanted nothing to do with helping me.

I used to pay online by direct electronic transfer from my Checking account which was also with the same Bank to the Mortgage account which was with them too.
There was a mortgage insurance used to secure the loan and I was ripped off by being lied to that it was going to be $406.09 a month on a loan of about $280,0000. I was promised that after two years if I do not miss any payment or have any payment late for up to thirty days, they would let the mortgage insurance expire after February 2009. Based on this promise, I took up the loan and was coerced to pay the exorbitant mortgage insurance of $406.09 a month. For the first year, I had a perfect payment history with no single late payment. By March 2008, Capital One, then Chevy Chase Bank, saw that if I am allowed the freedom of using any available payment method to make my payment, they would end up losing the $406.09 I pay them on mortgage insurance after a year. Thus they changed the payment methods available to me, denying me access to online payments by direct electronic transfer.
I made a lot of calls to have this resolved but none of their employees agreed to know what was wrong but advised that I could continue my payments in the branches or call and pay over the phone with a fee of about $25 per payment. I decided to go to branches, feeling they might be up to a game, to make me default, so I was left with the option of going to the branches to make my payment. From March 2008 to August 2008, I used this form of teller transfers from my checking account with Capital One, then Chevy Chase Bank, to my mortgage account which was also with the same bank. I still had a very good payment history without missing any month of payment or being late for up to thirty days as the rule for dropping the mortgage insurance stipulated.
By September, 2008,Capital One Bank, then Chevy Chase Bank, again saw that denying me access to online payments did not cause me to default, so they increased the suppression by denying me access to teller payments. If tellers pull up my account, they would tell me it is blocked and that they would not be able to take my payment. This was happening, while I was very current with my payments. I made all the calls I could make, talked to as many people as I could but no one could help me resolve this matter, as I was left with the alternative of having to wait for the bank manager to take my payments anytime I was in the branch to make a payment.
The most difficult aspect of the whole experience was that the bank manager would have to call the mortgage department to get instructions on how to take my payments, in a time and period that I had a very good payment history. On some occasions, I would be in the branch to wait for my turn to see the manager, and if it is 16:00 in the evening, the bank manager would tell me to go and come another day because the mortgage department was already closed, causing me to lose many hours of my work time. I was basically left to make my payments only five days in a week, and from 9:00 in the morning to 16:00 hours in the evening, when the mortgage department would still be open.
Despite these difficulties, I still persevered knowing that after February 2009, it will be over, since the $406.09 of mortgage insurance would be removed. Then I would go ahead and refinance my mortgage with another lender since my credit score was very high then. From September 2008 to February 2009, I was obliged and forced to use this method of payment. And I did everything possible to make sure that I never defaulted in my loan. Then came March 2009, the month the bank was to remove the mortgage insurance. I got a letter of foreclosure from them instead when I asked them to remove the mortgage insurance since the two years have gone through without my missing any payment and never being late for up to thirty days in any month. They denied receiving the payments for the months of December 2008, January 2009 and February 2009.
I sent the receipts and letters from them showing these payments were made, they acknowledged the payments for December 2008 and January 2009 and still deliberately refused to acknowledge payments for February 2009 which I actually made to the bank manager in the Annapolis road branch of the Chevy Chase Bank, now Capital One Bank.
I called the mortgage department again to express to them that I made that payment and was told by Ms. Hernandez to go to the branch where I made the payment. I went to the branch and met with the branch manager on duty, who called her colleague who accepted the payment. Her colleague confirmed to her that he accepted my February payment and carried out the instructions given to him by the mortgage department as they could not take my payment directly and I was not in default of my loan since according to what he saw in my account, I had not missed any payment or been late for up to thirty days in any month.
Ms. ****** the branch manager on duty did a great job, calling the mortgage department to tell them that it was not my fault, that my payment was made to them on time and so their penalizing me was wrong. I did not know that Capital One Bank, then Chevy Chase Bank ,had already reported this to the credit bureau, causing my credit score to drastically reduce by over 150 points within just one month.
Karen *** the credit analyst for Capital One Bank, then Chevy Chase Bank, wrote me a letter apologizing for the false report and promising to correct the false report, but never did that. Then when I insisted then to have the mortgage insurance removed since they have acknowledged now that it was their fault not mine, they refused insisting that I would still have to keep on paying the mortgage insurance whether I liked it or not for another year.
I went to make my March payment, but was told that they had an instruction in my account that nobody should serve me or take my payment again in any branch. I tried three different branches and received the same reply, that if I wanted to pay I should go to their headquarters and submit my payment. I asked why, have I done anything wrong, have I defaulted in my loan, is it my fault that I was current on my payments and should be given the benefit of being a good customer, who made sure he made his payments. Were they expecting me to default in my mortgage so as to suit them in continuing to collect the rip off of $406.09 every month? What did I do wrong in making sure that I maintained a good payment history in the midst of all their suppressive and oppressive acts to impose a default and an irreparable damage on me? They have damaged my credit, so I cannot refinance again, or even obtain a loan for my company, or school.
Until the present, they still refuse to solve this problem. This is my predicament with Chevy Chase Bank, now Capital One bank, by merger. I have tried to talk to them and in trying so and moving from branch to branch to solve the issue, they caused me to lose my job, talking with them over the phone while at work and even going to branches to ask that they resolve my case. They kept on giving me a runaround and still insist that they will never remove the mortgage insurance nor take my payments in any of the branches again. My house is now full of mold caused by the leaking roof, as I do not have what it takes to fix it again, since their false report to the credit bureau caused me both my job, and the refinancing that could have helped me fix the leaking roof to avoid mold growing in my basement and endangering my health and those of my people.

On 12-14-2010, I was contacted by Capitol One to make a payment of $255.04 (I have confirmation number) to prevent my 2010 Mazda 3 from being repossessed for 20 days. They also were told and agreed to remove the auto-payments that were going through my checking account and being returned as I was hurt on the job, not working and not receiving any income until unemployment restarted. On 12-29-2010, in the middle of the night (15 days later), they repossessed my car! When I called them to find out why they had reneged on our deal, they said the returned auto-deduct from 12-15-2010 (that we both agreed was not going through on 12-14-2010) that caused my account to be in arrears again. Don't trust anything they say. Liars, liars, liars.

I received an offer from Capital One for convenience checks with a promotional rate of 5.99% as long as checks are posted by 11/15/2010. So I wrote two checks on 11/7. The first was posted to Capital One within a few days and I received the promotional rate on it. The second was posted to the Capital One card on 11/15. When I received my statement though, I did not get the promotional rate even though the mailing clearly stated in multiple places the offer was good through 11/15. Thankfully I kept all the paperwork. So Capital One is incorrectly charging the wrong interest rate on this transaction, a much higher one of 17.9%.
I phoned Capital One and was on the phone for 30 minutes with a representative stationed God-knows-where who could not help. The supervisor he transferred me to was better; she is sending this over to another department to review. Just in case that is not enough to get this corrected, I just wrote their "disputes" department, and I am sending copies of all the paperwork I saved, including the initial offer which clearly states "must post by 11/15". Here's what I am sending them, minus of course the dollar amount and other information that is personal.
And my caveat to you reader, is to save paperwork and check your statements carefully, especially when dealing with Capital One. I am writing to notify you that you have made an error in the interest rate being applied to the transaction dated November 15, 2010. That check qualified for a special transaction rate. Please rectify your error immediately, adjust the interest rate retroactively to the 5.99% rate that should have been charged. Otherwise, I will be taking legal action.

I had a credit card a few years back with Capital One that had a 500$ credit limit. Though I made my monthly payments on time, one payment arrived late (though I did mail it on time), and I got charged two fees that put me over my credit limit, which followed with a 39$ over limit fee.
I was still a teenager and had just moved out on my own and this was my first credit card, so I was naive and didn't know what to do. I worked two jobs just to cover my bills, but now I owed Capital One a 250$ payment I didn't have. I paid it, but the next month they charged me another 39$ fee for being over my limit the previous month. There were so many fees that it seemed there were fees for them charging a fee. Needless to say, that overlimit fee put me over my limit again. See the cycle? I called and asked if they could close my line of credit, and we could schedule a monthly payment that would result in closing the account. Well, there was no option, I either had to pay the entire balance to close it or just deal with the cycle of fees.
I fought and fought with what little money I could spare, until I eventually figured food was more important, gave up and told them to send it to collections. And now there sits a notice on my credit report for 1,600$ which is increasing each month. On a card that had a limit of 500$. How I can owe them over three times my credit limit, I do not know. I'm not about to pay them three times the agreed credit limit, but they will not settle for any less. Also, no payments, they want the full amount and not a penny less. But now, of course, I cannot get financing for anything from any bank, which is making it pretty much impossible for me to dig myself out of this hole. Something needs to be done about this company before they drag us all down.

Refund of 199.99 from OmniTech.com on 12/24/2010 have been placed on my account as a hold of funds available. This purchase from OmniTech.com was on 12/12/2010 for 199.99 for repair of my computer, which had only further damaged it needing a person from the Geek Squad to repair these damages on 12/22/2010. After demanding a refund within 10 days, I have received both an email and a recorded phone call informing me the refund had been initiated on 12/24/2010 at 7:51 AM to my credit card. Capital One now has informed me this merchant had authorized a second debit from my account, instead of a return. Currently, all attempts of fixing this issue have failed.
The only authorized purchase by me was on 12-12-2010 through this merchant. This has left funds needed for medical prescription, which needed to be picked up on 12/24/2010, unavailable. Not to include funds needed to fill the gas tank of a U-Haul rented in Portland, Oregon which needed to be returned on 12/26/2010 in Seattle, Washington. I have contacted Capital One by email and phone disputing the charges being held as I have not given anyone permission to charge my account a second time. I have informed them of email received on 12-24-2010 from OmniTech Support: Confirmation of refund initiated which they want a paper copy of instead of forwarding an email copy.

I had purchased services from a vendor at Omni Tech .com to repair my computer on 12/12/2010. This only further damaged my computer and I requested a refund within 10 days. This refund was initiated on 12/24/2010 to Capital One. But instead of gaining a refund from Omni Tech. I was charged a second time and Capital One has put a hold on this amount. I am now without access to $399.98 of my funds with Capital one.

I called Capital One Credit Card Company and tried to pay off my mother's credit card. She had 7,506.00 on her balance and I checked to see the payoff. They told me over 8,000.00 dollars due to the interest of a cash advance that she did over 8 yrs ago! She has paid every month (on time) and they are literally ** her! They don't want her to pay off the card because they need the money that they are receiving in interest from her. She pays 160.00 to 170.00 monthly payments and over 100.00 is going on interest.
They said that she did not pay off the cash advance so she is at 24% APR instead of 15.9% APR. This is wrong! She is a senior citizen and if they are doing this to her, they are doing it to millions! How much money are they making. They are not trying to help the issue of this economy, they are making it worse! When I ask the Senior Account Specialist to speak to higher up, she said that she is the highest and we can send a letter. This is not right and I will go as high as it takes to be heard!

I canceled my Capital One account in August. They said that I should pay the outstanding balance less the membership fee and they would refund the fee and close the account. Three months later, they say that they won't refund the membership fee, even though I've called every month and verified with them that the membership fee refund was pending.
I paid the outstanding amount in full and I am looking for others to join in a class action looking for refund of the membership fee, attorney's fees, interest and other expenses. I have seen many similar complaints here and have retained legal representation.

There has been a class action lawsuit filed in Florida in the U.S. District Court for the Middle District of Florida, Tampa Division (re: Spinelli et al. v. Capital One bank (USA), N.A., et al., 8:08-132-T-33EAJ). The case has been settled, and I am one of the plaintiffs. I bought payment protection insurance for my accounts, which provided debt cancellation when certain events, such as involuntary unemployment, disability, or death occurs, and is an amendment to the Capitol One credit card account agreement.
Capitol One provided its customers insufficient pre-enrollment disclosures about Payment Protection restrictions. I was involuntarily unemployed, and Capitol One only paid for one year of unemployment. I did not know there was a limit. The account ended up becoming charged-off, and now I have been sued, and a judgment obtained for over $1,900.00
My original limit with Capitol One was $500.00. My question is, since Capitol One has been found in the fault for this misrepresentation, what can be done about the judgment? It seems so unfair to purchase credit card insurance and not have it honored. This is an extremely difficult financial period for me, and I want to know what can be done. I am unable to pay this credit card debt especially when the interest alone is almost $800.00 and is accruing at 13%.

Back in early 2000, I received an offer from Capital One for a credit card so I got a credit limit of $300. After about 6 months of paying on time, the limit was raised to $1000 without notice. About one year later, I fell into hardship and could not pay it off so I made minimum payments. In mid 2000, I tried to rent a home for my family and my credit check came back saying that I owed Capital One $1500 and needed to pay the minimum payment or I could not rent the home. So I called Capital One and asked them if I only had a $1000 limit, why do I owe you $1500? I was told it was all fees and my minimum payment is $460 so I made an online payment of $465 of borrowed money so I could rent the home.
A few months passed of me making minimum payments and I get a statement saying I owed $1600. I call Capital One again and ask why do I owe $1600 if I make my minimum payments and I just made a $465 payment. They told me my payments were always late because they never made the cut off time of 4:00p.m.and if the balance was not paid in full, the fees would keep rising even if I paid my minimum payments. So in anger, I stopped paying all together.
A few years went by and I get a collection letter stating I owed Capital One $3900 and would settle this for $2900. So I call the collection agency and tried to explain that I only had a $1000 credit limit, well they wouldn't hear anything I had to say. So I try to offer them $150 a month payment plan, I was told no and that I had to pay in full. I did not have that kind of money so I told them I could not do that, then never heard from them again. A year goes by without word then out of the blue I was served with court papers stating I was being sued by Capital One.
So I contact the attorney's office who is handling the case and was told, and I quote "if I did not agree and sign the documents that they were going to take my car and 40% of my wages will be garnished from your employer". I tried to explain to them as well that I did not owe the amount that Capital One is saying I owed them. Their reply was if I had any documentation to prove that I owed them any less than what was asked for, which I did not have so I plead to them that I had a family to feed. And in fear, I did what was asked and I am now paying $150 a month for X amount of years which is so far totaling over $7000.
Recently, while cleaning out old paper work, I find the collection document stating that I only owed Capital One $2900, which is still a lot higher than what I believe I owed them but a lot more reasonable then what they are getting out of me. So I call the attorney's office and tell them I only owed this amount and now have proof and they tell me it's too late, you should not have signed the documents now you owe this amount. I myself and everyone that will hear me cannot believe how Capital One is getting away with doing this to me and thousands of others.

Every time I turn around, I get a credit card offer from Capital One. They checked my credit every month without my consent. This is hurting my credit. I have also opted out and still get offers.

I opened an account with Capital One 4 yrs ago while in Tx. I then moved to Ky where the closest bank is over 100 miles away. This was no problem since I had direct deposit. My plant closed their doors recently and I became unemployed. Unemployment checks do not get direct deposit. So I opened an account locally. Since I did not have money to order checks, I connected both accounts together so I could make transfers from one account to another.
On Dec 6, I scheduled a transfer to my Capital One account. Since I do all my banking online, I kept track of the deposit. It was shown in pending on the 7th but was put in as a deposit on the 8th showing a date of Dec 7. The checks for the bills hit the bank on the 9th and bounced. The bank charged me $35 each on no funds available due to funds being placed on hold. The transfer was supposedly put on hold for 3 days even though my account was showing the deposit. My money was in the bank but they said I couldn't access it.
I called customer service at least 4 times trying to get the fees taken off. They said it was not a bank error. How can my money be in the bank one day and not there the next? They told me that the transfer was put on a three-day hold but the online system said nothing about a hold. It still shows money was there on the 7th as a deposit. My other bank shows it cleared on the 7th but Capital One says it takes three days.
How is it that it only takes seconds to withdraw money from an account but it takes the banks days to deposit it? It's not like it was a personal check. It was bank to bank. This is not the first time Capital One took money. Last year at this same time, I cancelled an automatic bill pay. They paid it anyway and ended up bouncing 7 checks.
Why does it seem like at the end of the year, the bank takes money and says it's not a bank error. even if it technically is? Is it just so they can give their CEOs and managers Christmas bonuses at our expense? When are the American people going to say enough is enough? The banks have more power than what they should have. If my money is there, it should be there.

I tried to cancel my card. Balance is 0, but they refused to do so. I had to wait for the next billing cycle. Next billing cycle came around and they charged me a membership maintenance fee. Called to complain, and they told me, they would cancel my card as soon as I had a balance of 0 dollars. I'm speaking to my attorney about this immediately.

During the weekend of 11/27 - 11/28, our household received calls at 4:00, 5:00 and 6:00 am from an 800 service. We tried to ignore them, but since they woke us with alarm, thinking that something serious had happened to family or friends, we decided to answer the last call. It was a collection service looking for someone who owed on a Capital One account.
After giving the person on the other end a tongue lashing for having the nerve to call us at this time of day, we made sure we were taken off the call list. I then tried to contact Capital One at their corporate offices to bring this matter up with them. Suffice to say, I was not successful in breaking through their barricade. I am attaching an email I sent to their PR person, Tatiana **. It will describe what has transpired up to the present.

I am writing to you because you have failed to return phone messages from me for the past two days. Over the weekend, I received a number of calls from a company that is contracted ultimately by Capital One to collect on outstanding debt. These workers have called my home at 4:00 am, 5:00 am, and 6:00 am on a weekend. This debt is held by someone who is not even a member of my household, nor for whom I am responsible.
You can imagine my trepidation as I hear the phone ringing at this time of day. "Surely someone is seriously ill or worse in my circle of loved ones," I think to myself. I was incensed to learn that it was a call trying to collect on debt not even associated with me or my family. I took care of the situation with this company, but I feel that your organization bears final responsibility for this since you contract with them. It is beyond inappropriate to receive calls such as this for a matter that does not even concern me! Capital One needs to stop this practice immediately.
When I attempted over that last several days to contact someone at your corporate headquarters, I was repeatedly routed to account representatives who have nothing to do with this sort of situation. This was after being placed on hold for 10 minutes at a time. When I finally did get through to your assistant, Armir, he was curt and hung up on me because I was upset. He acted as if he had taken my phone number for you to return my call, when in actuality he hadn't. When I caught him in this, he told me he could not help me if I had an "attitude" and then when I expressed my opinion that it was appropriate to have such an attitude when this happens to me, he hung up on me.
Is this an acceptable way to do business? I think not. I would think that those who work in the field of public/media relations would be better equipped and willing to deal with upset consumers. It has become very clear that Capital One has little to no regard for its customers or the consumer at large. Your company makes it impossible for one to speak to anyone except your lowest level account representatives, regardless of the situation. You insulate your upper management and staff from a concerned public, and if someone penetrates that layer, they are dismissed by you or dealt with in a rude manner. This indicates to me a corporate structure which lacks integrity and good moral character.
I have filed a complaint with the FTC against Capital One regarding the matter of the original phone calls. I am informing all of my family, friends and associates of the manner in which your company does business. I am also sharing my story with the media. I would hope that you would address this issue in a responsible manner.

We made a deposit on Saturday, 11/27. Our online banking balance showed us the money was readily available. We paid bills and bought groceries all weekend. Tuesday after checking our bank balance, we say we were charged for overdraft fees for a total of $245.00. We called and were told these would be refunded. This morning, there was three more totaling $105.00. After calling twice, one representative hung up on me. We were refunded only four of the charges. The other three were not refunded. That was our bill money! We had more than enough money to cover all of our purchases. With money left over for gas, now, we are still in the negative and Capital One refuses to refund us our money. I have emailed the governor of West Virginia, speaker John ****, Senator ****, and Capital One. I want my money refunded! We work hard. We can't afford to give a bank $105.00 of our bill money!

I made a mistake when making an online payment from Bank of America to Capital One. Instead of $3200, I made a payment of $32,000. I discovered the error the day after the transaction was done. The bank and Capital One could not "stop" or "refuse" the transaction. Now, two weeks later after many calls to Capital One and many promises from Capital One to "electronically" transfer the funds back to BoA, the funds remain in my Capital One account. The promise today is the funds will be back in my account by Saturday. The representative also said it would take 4 (four) business days. I have lots of confidence that she was making it all up as 4 business days, if processed on Thursday, might result in the money being transferred on Wednesday of next week. Gee, I wonder why I have no confidence that I will ever see my funds again. I guess I could go out and buy a car on the credit card. Don't continue to patronize Capital One. Forget "no hassle" at Capital One.

I recently received Capital One's privacy policy notice, which states that they can share my social security number with other companies. Given the huge problem with identity theft, I'm not comfortable with that, but according to the notice, I'm not allowed to limit their sharing of my social security number with other financial companies and their affiliates. I was unemployed for over a year 2008-2009, and was a Capitol One Credit Card holder at the time. I made several attempts to work out repayment terms with their customer service department. But my calls kept getting routed to a call center in India where communication was impossible because of the language barrier. After several requests to speak to a rep in the United States, I was transferred and placed on hold many times, always ending with the call being disconnected or being cursed at in a foreign language and hung up on. When I did here back from this phone center in India, it would be in the form of phone calls at all hours of the morning such as, 1, 2 or 3 am.
While I was not making much on unemployment, I sent in whatever payments I could muster and was in a frenzy to find any employment I could. At some point, my debt to them went into default. And the insuing 45% interest ballooned the amount owed to over $7,000.00. Capitol One turned it over to collections in the U.S. My wife and I were subject to a series of harassing phone calls, even going as far as speaking on the phone to my 9 year old daughter and at one point, to a visitor in our home on one occasion earlier this year.
I was called one particular Saturday morning by a collection rep who refused to identify himself. This person opted to yell and scream at me about repaying my debt immediately or be subject to losing my home. He ended the call by referring to me as a, "deadbeat Sand **". I asked him to clarify that, but he laughed at me and hung up.
I enrolled in one of those debt repayment services over the summer. But the service informed me that Capitol One refused to negotiate any repayment proposal with us as they had written off the debt. The latter part turns out to be false, as Capitol One has served me with court documents with intent to sue for the amount owed including interest which is still accruing daily, plus any legal fees they have incurred and/or put a lien on my home.
A few months ago, I borrowed $500 from my extended family and sent it directly to Capitol One with a note to indicate that they accept it as a "show of good faith" to repay my debt. But all they did was take my money. And they relentlessly continued the harassment on the phone until I had to disconnect my house line when the calls became overwhelming and my health and stress level became alarming.
I am a Type II diabetic. This situation has caused me many sleepless nights and my wife much unnecessary stress, not to mention a strain on our marriage. I have returned to work now going on a year. But every day I panic that this company will eventually begin calling me at work and ultimately cost me my job when they bring my employer into the issue.
My wife and I have two young children to worry about. And we struggle every day to maintain a stable environment for them so they don't have to stress about our financial business. I know Capitol One is a big corporation with many legal resources at their disposal. But what they are doing is flat out wrong to us and we know we're not the only ones. I have never shirked on my debts. But this current economic climate has devastated many. And these people should not be allowed to carry on in this manner at any time! I know there are consumer protection laws in place. But it seems those laws don't have any teeth as Capitol One doesn't seem too concerned about what the law can do to them. I hope you can offer some kind of assistance or advice.

After years of being a loyal Capital One customer, I had two cards. A $500 credit line from college days and a $2500 credit line card with rewards. Both were no annual fee when I signed up and had been for years. Recently, on both cards, have a $5 a month "membership fee" which would total $120 a year. I called customer service and after explaining the situation, they said it was due to economic times and that there was nothing they could do. They agreed that Capital One would rather lose a customer and that customer to tell everybody they could to avoid Capital One than to remove or lower the "membership fee." Cut off your nose to spite your face, I say.
Extra $120 membership fee when they can get interest fees plus merchant fees on my purchases. All my other cards are no annual fee (Discover, Citicard, Target visa, US Bank visa, Direct Merchants, etc.). Goodbye Capital One. They won't let me close account until balance is zero. My original agreement with them was no annual fee.

called Capital One agent, they said there was a pattern of fraud activity. I told him all I did was put $23.00 in gas and tried to pay AT&T. That is not fraud activity. The agent said there was other activity, but I know for a fact there were none. Then he said he was not allowed to tell me because he did not know I was me. So he said fax me documents.
On 11/16/2010, I faxed all documents. I called the agent. He said it will take up to four days to verify that it's me. On 11/18/2010, I called the agent just to see how it was going. Agent Aron told me my account was closed on 11/16/2010. He said everything was verified and the account was closed at my request. I asked how can you verify me when it takes four days to verify everything. Then I was disconnected. I called again and spoke with Francis, a supervisor. She said, "Let me check." After 5 minutes she came back on and said it was an error. I asked Francis, "Are you sure? Because Aron, the other supervisor, said everything was verified and the account was closed at my request." She was silent for a moment then said I need more documents faxed. At that time, I gave up because I know I will get nowhere with them.
The closed account will appear on my credit report affecting my credit score. I did nothing for Capital One to say there was odd behavior on my credit card. I know there was no odd account behavior. I asked what other charges were on there. They said they cannot tell me. How can I get this cleared up where it does not affect my credit report?

My Husband and I are small business owners in Wisconsin, we're mason contractors, so construction jobs are very hard. We were with capital one for almost 10 years and me being the person I have to be felt the right thing would be was call Capital One and just give them a heads up and that's what I did but just out of respect we were fine now. But in several months, who knows and they seemed great about me calling just for a heads up and if something came to that they would work with us no problem.
Well it ended up in August, were we really had to cutback but we had tons of jobs and hiring at this point but starting over. I called Capital One to make my payment because they have had us locked out for months on the computer. We have asked so many times and they don't unlock it but I made August and September payments over the phone. The CSR set up both dates for auto from my checking. Well, I didn't like that, she put it August 31st to close for 30 days. I got my husband to pay early and more we sent 4000.00 2000.00 for August 2000.00 for September but on August 18th, we called and asked if we could use one of the checks they sent us. We normally don't use them but had to for this month.
We were told, yes, everything is fine there is no problem and we could use the check for 3000.00 at the same time my husband was doing a loan for a line of credit for the business 'cause we didn't work for several months. We needed the credit for payroll just till we got everything going again plus with expanding but loan dept called and said Capital One reported us as being 30 days over for August. It's only August 18th, how can that be? So, we talked to a supervisor who said he would check it out and get back to us in 3 days. Well, on August 24th, my bank called, told me Capital One returned their check. I was floored. I told my bank that I called and they gave me permission that I could use it. So, on the 25th at my bank, we called Capital One, I was told they returned it cause we didn't renew are new cards but my card is still good till the end of August. And if it was a problem when I called and ask if we could use the check for 3000.00, why not say something then.
So, a supervisor talked to my bank manager and told them that it was a mistake and they could accept another check in which I said 3500.00 because they drained my savings top cover checks and massive bank fee's and we would figure out the rest later but again was promised that the check is good there's no problems, that they can deposit into our checking, so our bank manager did. We still heard nothing about reporting us to the credit companies but on August 31st, my bank called me, to tell me again that Capital One sent the check back again. Now, that has been 6500.00 in then right out my house payment was used for other checks. I was so in the whole.
They completely broke us. I'm 100% disabled, I couldn't even get my medications or my husbands who is on 3 types of high blood pressure. All we got was just major run around, nobody noted our account, so when someone would read it nobody could understand it, my husband called and we have passwords and one CSR told him he had to go to a bank and show them his ID. and call back to let them know that he is who he says he is. Why did we set up these passwords, so there were no crap like this.
Well, we are into November, I called their fraud department. They did help us the best they could. They put the 3500.00 back but I was given 100.00 for our troubles in which Capital One is charging me for and saying we are now over our limit but one thing they sent me letters. I don't think they realize what they did and I have, so I want to find an attorney because I will not make a payment. I have called so many times to try and work this out but they expect us to eat this major loss

I have a credit card with this company . I have never been late; I cancelled my card due to this fee. I was told the fee would be dropped because I cancelled my card. I said that's fine. My payments have gone up but I'm still paying on time. Last month, Oct. 2010, this fee is back. I called; now they are telling it's because I didn't pay my card off. I ask where does that say in my contract. She(supervisor) said, "you don't have it, we do." I ask for her to mail me a copy. She said, "We can't do that. You have to take our word for it"! As crazy as that sounds, it's the truth. What can I do?

Let me start by saying that Capital One is probably the worst bank I have ever dealt with. My first encounter with them was trying to redo my mortgage. My wife had lost her job and her unemployment was going to run out. I called and spoke to a person about a refinance on the mortgage, come to find out that Wells Fargo holds the mortgage, they just service it. I told her I didn't know that and she told me I didn't need to know that.
After about 20 minutes of going back and forth to try and refinance or redo the loan, they told me to sell my house and buy a less expensive house. How rude and uncaring they are. My second and last incident was using the bill pay online. I had scheduled a mortgage payment for the 12th of November, they paid it on the 10th causing an overdraft--costing me $35.00.
When I called, they would not credit my account, and said that because it is a bank check, they have no control over when it is presented. I do understand that and explained that I have seen my mortgage payment sit on pending payments until the day it was due. When I asked why this had changed, they said nothing that made sense. They would not credit me my $35.00. Solution: I have opened a new account with a Federal Credit Union. Before they got into the banking business, they had a bad reputation with their credit cards. Now, they want to have a bad reputation as a bank.

Capital One has called numerous times a week saying that a statement has been returned; however, not in our name. I have asked them to stop calling, but they said not without providing a SS#. I said are you out of your mind? I know my rights. I have contacted our local police who said BBB should get involved.

In August 2010, I received an offer from Capital One Credit Cards for a balance transfer from other accounts at a 0% interest rate. I completed the balance transfer on September 8th and paid them $86.98 for the transaction. I have always paid the purchases portion of my credit card statements off monthly in order to receive no interest charge. I paid the purchases off in September and paid additional to be applied to the balance transfer portion.
I then noticed an interest charge on my October statement. I was told that I now have to pay the entire balance off, not just the purchases portion in order to have no service charge. I asked and spoke with a supervisor who told me this was incorrect and did not have to pay the entire balance, just the purchases portion. They credited back my interest, and said a new statement would be sent.
Never received. Followed up and spoke with a Sr. Supervisor who said that in fact I would have to pay the entire $6380 balance off, not just the $2254 purchases portion in order to not receive interest charges. This seems absurd to me in that I would have never done the 0% balance transfer if I knew I had to then pay the whole thing off.

On November 08, 2010, I noticed a charge from Capital One on my Bank Of America bank statement for $77.00. I was surprised because I didn't authorize for them to take a payment from my bank. I called and found out that on November 6, 2010, one of their collection agents, found out in the system that I authorized a payment and made a payment plan with them, which I didn't.
The agent's ID number is ** and they claimed that at 8:30AM they called **, (which is not my number), and we agreed upon a promise to pay. When I called Capital One, they told me that my money would be returned to me by that Tuesday. When it wasn't returned on Tuesday, then it was Wednesday. Needless to say Wednesday came and still nothing. I have complained and spoke to my bank with no results. I'm concerned because what was done was theft, plain and simple, and I would like to know how many other customers are they doing this to? I want to file a class action lawsuit, because what they are doing is illegal, and I'm sure it's causing hardships on people. I have a 9 month old daughter, and that money was going to go towards her daycare, which I can't pay now.
I'm really upset and want to know what my rights are, and who should I contact about this situation. The customer service reps have all been useless and uncaring, except for one named Michelle. She was the only one who tried to help me. Capital one needs to be stopped. They can't just go into people's bank accounts when they chose to. I have been unable to pay bills and get items that are needed for the care of my daughter, such as diapers, milk, and gas, to go to and from work for the week. They have caused a hardship.

I haven't received a bill or statement in over two months now. They told me that they attempted to send a new credit card to replace the one I have that expired this month and both times, it was returned to them undeliverable. They confirmed that they have my address, and the Post Office has no explanation why it would be returned unless they didn't put the correct address on it. They mentioned that it may have the wrong bar code address on the envelope that may cause it to be returned undeliverable but clearly, this is a Capital One problem not theirs.
I've called and emailed them at least ten times now. I refused to talk or deal with their Indian call center and now I am no longer able to access the online site to see a statement since a supposed new card has been issued. The account number I have will not open the site any longer. I feel that they are just trying to piss me off to pay off their card. I do plan to do so soon but for now, I need to pay a payment so they don't turn in a bad credit report on me. This is crap. Do you have any suggestions.

I have a Capital One account with a limit of $5,000.00. I have paid it off many times but they refuse to update the payment to reflect that it has been paid off. That is, if I charged $1000 leaving $4000 available credit, then I make a payment of $1000, the website shows part of that $1000 payment applied to the amount charged which is $950 and some of it left as a credit balance of $50. When I have a credit check done, it shows that I have never paid the card off completely even though it has been paid off many times.

I had a $500 credit limit on my Capital One. I was clearly under the limit at one point because I had made regular recurring payments monthly and have not charged on the account. Months later (from May to November), I received calls from company. They retorted that I was $274 over my credit limit and my account was now in their Collections Office. I asked the representative why all of a sudden my account was over the credit, as I have made payments and have not made any charges since May. They retorted that my payment for May had bounced and thus, a late charge was incurred allowing it to go over the limit.
Every month, it was over the limit and they charged me $39. When I asked to speak to Customer Relations, the representative said that I had to clear the $274 over the limit fee first. I was outraged as I asked to speak to someone who would be able to help and then a supervisor was placed on the line and continued to convince me to pay $274. She could do nothing to remove charges. I felt gouged and hurt and asked for a stop payment until I can get a debt relief company to help but she said that she would send a stop payment form and it will take two months (two business cycles) before it stops. I felt very bad at this point because they could not honor my request even though I have been diligently allowing recurring minimum payments monthly.
Capital One and other creditors like them should be disciplined because of their practices. This once was an America, where we could freely trust our banks to protect us and our investments. Now, they are the monsters that destroy our people and our nation. The main war on terror is not the Middle East, it's within the boundaries of USA. I got economic and mental trauma due to the gouging effects of Capital One's practices.

On Monday, November 8th 2010, I received a call from a lady who said that she worked for Capital One. When she called me, it was around 4:15 in the afternoon and I was tied up trying to fix dinner and I told her to call me the next day. She was trying to give information on the phone and I said to please call around 11am because I could not get to a paper and pencil because my hands had stuff on them. She directly asked me if I wanted to cut my interest down on credit card and I told her that I would talk to her the next day.
On November 9th, she returned my call like I requested her to do and as we were talking, I was taking down the information she was telling me on how I could cut my interest down on my credit card. I asked her if I cancelled my card two years ago, why am I getting charged interest on a card I don't use and I don't have. I even sent it back all cut up and told them to cancel my account.
As she was telling me the address to where I could send a payment, she was asking a little more personal questions about my financial situation. I told her I could send her $50.00 today, and then she wanted to know how much money I had in my bank account. She also wanted to know how much money I was receiving on my unemployment and I told her that it was for me not to disclose. I also told her that for two and a half months, I did not receive any money until lately, and this time my unemployment is going to run out. She asked me how far the bank was where I lived and I told her 47 miles away. I told her that I live in a small town where there is not much work is happening, and I have tried to get a job several times but I am 57 years old and they are looking at my age now, and it is not easy.
As I was trying to write the information she was giving me to where to send the payment, she asked me to repeat it to her and as I was repeating the address back to her, she was getting upset. I tried to listen to what she was saying but as it was not my fault, this woman did not speak good English. She had an accent and a temper then she hung up on me.
If you're going to hire someone to take calls for people, make sure that they know how to use proper phone manners and speak good English. I was trying to get the information down the best I could and I even repeated myself to her but she was loosing her patience, and hung up. How rude.
I lost my job over two years ago and in this time, my mom passed away. Other things happened to subside in my life beside struggling to pay bills and trying to survive then have someone call me and hang up when I am trying to at least make a partial payment and get the information down. She wanted me to make $200.00 payment this month. I am trying to do the best I can but having impatient people on the phone does not make my life easier.
It is stressful enough to live now and I feel Capital One should not charge people interest on cards they don't use; check my account on when I used my card last. Why should people pay interest on a card that they don't use and hassle people on the phone over money they don't have. I am suffering enough with the way the economy is, and I tried sleeping at night, wondering if the next day if I am going to have a meal or not.

My due is the 27th of each month. I made a payment after 5:00 pm and I was charged a late fee. I think that is abuse because when a payment is made before 12 midnight it is still the same day. Late charges should only be applied when a payment is late, not the same day it is due. I am very upset with all the extra charges that is being applied to consumers.

I never missed a payment on any bill since one time in 2001, however, last November 2009, between salary cuts, raised rent, raised interest rates and an injury--the perfect storm. I couldn't pay my rent and my credit cards, I started to miss payments. I called my creditors to see if they can help me, skip a month, lower interest anything and I had cooperation and assistance with all (even with Bank of America), but Capital One wouldn't help at all and continued raising my interest rate.
I couldn't pay anything but my rent and the lowered bills. I stopped paying and told Cap One over and over my situation. They could do nothing. My family has helped me a little, so in July, I called Capital One to see if there was a way to get a payment plan and to take off all the extra fees and late charges.that was now almost double my bill. They said, the only way to take all the interest charges is if I pay the entire balance off at once and give them $1000 tonight. I couldn't do it.
It then went to collections in August, I called collections if there was a way I could get a payment plan or do something. The collection agent says, the only way to not pay all the extra fees and interest is to give them $1500 immediately and I told them I couldn't do tonight, but would see maybe in a week or so if I could work something out, the agent goes if you do not give us $1500 tonight and give us your checking account info right now I am reporting that you are not cooperating.
I told them how am I not cooperating I called you. He demanded my checking account information or they will not work with me. I hung up. In September, I had surgery and 1 week ago, I called up Capital One to see if I can get my card resolved. They kept on connecting me to their collection agency. I spoke with someone who said if I paid $500 they would take off all the interest and then I just need a payment plan but he had to talk to his supervisor.This woman comes on the phone and starts screaming at me and says the only way we take off all the fees is if you pay the balance in one payment and you have to give us $600 today. I told her I can not afford that, but still asked her I needed information in writing before I pay anything, then she starts yelling at me how she wasn't sending anything in writing since I ignored my statements that means I will ignore letters before, so they are not sending anything in writing, I have to give them my checking account info to get the $600 out. I said, "No way." (She also started yelling amounts I paid other creditors which is none of their business.)
I called you to work it out, so I why wouldn't I open my mail and they really think I am giving them my checking account info and paying with nothing in writing. I hung up. I called a few times again to Capital One to get some voice of reason who can help. Also, give me my correct balance since I can't get a straight amount with the fees and can't get a straight answer on what I need to pay to get the fees off. Needless to say, I am paying nothing back until I get correct information in writing, so after numerous attempts to get someone who wouldn't transfer me to the collections, I reached someone in Cap One customer service who took all my info and is going to call back. I have heard nothing yet.
I feel Cap One puts so many fees and ups interest rate to get people trapped and then doubles and triples the original bill. When you call to get help to start paying, they say you have to pay all the interest and fees unless you pay the balance in one lump sum, which most people can't or they wouldn't be in the position in the first place, and by demanding your checking account (which no one should ever do) and not sending anything in writing (again, no one should ever pay without a statement in writing) you can't pay at all and they keep on racking up the fees and charges which I think is there plan in the first place. Since, I have a friend who once worked in collections, Capital One already sold off my account very cheap to this agency. I was wrong to be late, but I tried in good faith to work something out numerous times.

Capital One called me about over the limit fees. He didn't explain the new law to me about the over the limit fees; he asked me if I would like to be able to go over limit for a fee. He didn't tell me that if I went over the limit I couldn't charge a fee if I didn't agree to it. So I said okay. Now after learning the new law about the over the limit fees, I am battling with them about this fee. I don't mind paying an over the limit fee because I went the limit, but they are charging an over the limit fee each month until I bring it under the limit. If I had known that I would not have agreed to it.

We had to begin making much lower payments on our account as we could not make the payment to Capital One and still pay our mortgage and living expenses plus all of our other bills. Twice now, I have spoken with an agent who has agreed we can pay a much lower amount of $60 monthly for a certain amount of months. Although this is exactly what I have been doing through "payee" on my checking account, Capital One calls our home at least 6-7 times a day, daily.
My husband became unemployed in December of 2008; he has been on unemployment insurance for nearly that long. After several extensions, the unemployment will run out the end of December 2010. Concerning the mortgage and at this point, we are unable to pay it when it is due but due to his SS check, we pay it within the grace period each month.
When I have talked with them and tried to explain most honestly our financial situation, I am asked, "Couldn't I do this or couldn't I do that? "It is like they truly do not hear what I am saying and believe I am withholding full payments just because I don't want to make them!
I truly, truly would give nearly anything to be able to catch up with the past due payments and then continue their stated payments each month until Lord willing, the balance is paid off. We simply cannot do this. I do not know where to turn for help to keep them from harassing on a daily basis and to keep them from calling many times a day.
I quit answering the phone altogether nearly a week ago. Speaking with them gets me no where at all. I need help as I (wife in this situation) am the one that handles the bills and the payments we need to make. I am pretty much alone in trying to keep our heads a little bit above water.

I applied for Capital one credit card I never received credit card. I never activated credit a Capital One card. I get a call from Capitol One that there was suspicious activity on my account. I received a statement with a $500.00 credit limit and no charges on statement. Next, I get a statement with past due $39.00 interest charge. I sent letters to cancel account. They would not cancel account, then I sent letters disputing interest. I got a bill for $54. I did not want this on my credit so I paid the $54. Capital One will not cancel my account or refund the $54.00 I still received a statement $500.00 credit line.

I have been charge $45 on a zero balance credit card. The representative say it’s a Capital member fee. I have already paid $15 and told me that Capital One has charge me $45 since 2007. I cancelled my card because of this issue. Now they say my $45 will be waived and I no longer owe them $45. They are going to credit me the $15 dollars I paid. This caused stress, anxiety, and headaches.

My son turned 18 and I helped him apply for his first credit card and got it through Capital One. I clearly remembered a check box for applicant who opted to have credit protect program which we didn't check off. After my son received his first statement, I noticed he was charged for it. He paid his card in full without thinking about it. Then when he received his 2nd statement, he was charged again, in addition to a $5.99/mo credit inform service. I asked my son to call Capital One and tell them that he didn't sign up for those services and he'll need his account credited. He has to call them separately at two different numbers although they're all part of Capital One.
He was on speaker phone so I can hear everything. Of course, each rep started to stressed the importance of both services and why he should have them. That's not even the point! They have no right charging my son services he didn't authorize! Then when he asked for the credit, the rep said he'd do that but asked if my son can go ahead and pay the minimum amount on the statement in case it's not done in time and he's charged late fee.
That's when I got on the phone and said to him that we don't care if there's any late fee charges because we won't pay for it anyways since the charges were not authorized by us. Then he said alright. I think it's absolutely unacceptable that Capital One can charge people's card when it's not authorized to make money. Not everyone review their monthly statements carefully and I wondered how many people have been scammed for services and paying for it without even knowing it. This should be considered fraud!

I received statement from Capital One bank and my interest rate was increased to 17.90%. I called Capital One, spoke to customer service representative and supervisor of accounts. They both informed me that letter was sent to me in 2/2009 about increase. I never received this letter and they informed me that reason for increase is due to economic changes. I am always on time with my payments, never late. I feel that they should have not done this. It is not right.

I opened the account in September 2008. I got behind on payments to the point that Capital One issued a letter to file legal action against me in order to satisfy the debt. I paid the debt in full on April 2010 after I was told that the account was non usable/closed.
I was happy with that because I wanted nothing more to do with credit card debt. One of the issues with my payment, however, is that I mailed it certified letter March 16, 2010 and it was not processed until (I think) March 24, 2010. After many calls and verbal and written confirmations that this account was closed, I still kept getting these statements every month. I called each time insisting to get this account cleared. I was concerned that I was going to get an annual member/service fee.
Low and behold this Saturday October 30, 2010, I received another statement with a balance due of $54.58. I knew it! Well, as I mentioned, in the last letter that was sent was a certified letter again. I was getting in touch with my attorney to resolve this once and for all and that is exactly what I'm doing—with a vengeance, I might add. They have harassed me for the last time! I certainly hope that this helps anyone that has had issues with Capital One. We'll see what my attorney has in mind.

I called Capital One and went over the bill with the employee and she was going to check on the problem and call me back.
She never called back, so I called the next morning and spoke to Brenda and she was finally able to make some resolution. However, Capital One uses any devious methods to try to increase one's charges. The issue was that I was short $1.00!! That is outrageous. I have always paid more than required or paid it off and yet they have twice tried to ruin my credit and make me look like a dead beat. So to placate me, Brenda removed the charges and gave me an extra 1000 miles.
Thank you but I spent nearly two hours trying to have this fixed and just the fact that they do not recognize overpayment on bills is just one of the reasons that I find this company as crooked. I have destroyed my cards and will never use Capital One again and will continue to tell everyone what a horrible company they are. I wanted them to send a letter of apology to the wine company but so far that has not been confirmed. I could go on and on but it would take a volume of paper to list all the problems with this company. I just think they should be looked in to.

I was sent an offer in the mail back in 1996 to sign up for a Capital One Mastercard. Though I just turned 17, I thought it would be a great idea to go ahead and start building my credit if they would give me a credit card. I received the card in the mail with a $200.00 limit. I never received a single statement from the company, but by calling the number on the card, I was able to track down an address and having the original letter, had the account number, so I sent in payments.
After several months, I realized I wasn't being very responsible with the credit card. So I called and spoke with a rep. at Capital One and asked how much I owed and told her I wished to cancel the card before I got in to trouble with it. She stated $200.00 would pay it off and they would close it out. I sent a check for $200.00 that they cashed and it cleared.
In approx. year 2000, I received a phone call from a debt collector stating that I owed over $600.00 on the $200.00 card I had. I told them no I didn't, that I paid it off and closed it. She said at the time the account was closed, I still owed $15.95. I said that they state when you call that they record all the calls, I told her to go back and listen to the recording. She said they apparently didn't have the recording from my call. I told her I had the lady told me to close the account. It would be $215.95, I would have paid $215.95! I told her I was in a good mood and would pay them the $15.95. They said I owed even though they had a mistake somewhere on their end. She said I was gonna have to pay them the over $600.00. Then I went on to state that it is my understanding that a person has to be 18 to receive a credit card. She said yes. I said look at the dates, I was 17 when I received the card and 17 when I canceled the card.
She said, "Oh my goodness, yes you were!" I told her that if they want to take me to court over this matter, I'm sure the judge could figure out from my date of birth how old I was. She stated that she would take care of it and quickly got off the phone. Present day: Now, I have never had another credit card since the one bad experience. I'm turning 31 next month, and today I received a settlement offer from a debt collector by the name of Portfolio Recovery Associates on a Capital One card with a balance of $990.20! My first thought was what is this. After calling the recovery company, it is for the same $200.00 credit card I paid off when I was 17.
This is completely ridiculous. This should have been off my record years ago. I am at my wits end with Capital One! Now the recovery company is wanting me to fill out some dispute forms and send them back. I am beginning to think I might need to involve an attorney. I would not recommend anyone to do business with this company!

I have never opened any type of account with Capital One or even stepped inside a Capital One branch office for the matter (I live in Wall Street Manhattan where the sidewalks are lined up banks). For the last 30 years my financial associates are CitiBank, Chase and Amex. I have a long standing relationship with them as they manage my personal and business accounts. It is obvious that I did not need any additional financial institutions or cards.
To my surprise, several years ago I found out, via my Credit Score report, that I had an account with Capital One. I immediately contacted them by phone and I was told that the matter would have been taken care of (they could not provide me with any evidence that I had personally opened the account). Since then, I have noticed a "charge off" appearing on the credit score reports.
Soon after, I got a collection agency harassing me every other day, calling my house, my office, talking to my colleagues, etc. To add insult to injury, I have been sued in the Civil Court for the amount plus interest (about USD 6,000)! I have started an official investigation with Capital One, Experia, TransUnion and Equifax. I don't know what to do anymore to stop this madness so that my credit will be restored to excellent (as it used to be before this Capital One mess). The situation is detrimental for both my financial and my image.

I finally got my Capital One Visa card to a zero balance. Two months went by and I received a letter in the mail from Capital One stating that I was going to start being charged a monthly membership fee for my card.
The letter stated that this change was because of my credit report. I immediately went to freecreditreport.com to view all three bureau reports. I discovered some inaccurate information. I contacted the credit bureaus and got the inaccurate negative items removed. I then contacted Capital One and spoke with both Ashley and Francis who both told me my only option was to pay the fee or close my account.
I cannot believe that Capital One would rather lose a card holder than remove a fee that was imposed based on inaccurate information. Beware of Capital One.

The day before my direct deposit is made, the bank charges NSF fees for items they say are pending. They tell me these funds are frozen; but the day before direct deposit, they run them thru and charge me even though I have the money in the account and prove it to them. I won't go into what they say due to the fact that it is all lies. I show them their own receipts, and computer print-outs from their site. Now, not only are they charging NSF fees, but they are returning items and saying the same things again. I have receipts of deposit that they will not honor. What the heck! I go to talk with them and I get told to take it or leave it. They laugh. What has happened to this country?
Things are bad enough with our economy. We all try to make it with what we have, but to have a bank rob you and do it with total disdain is rough to say the least. They charge me $35.00 for $0.09 over, or so they claim. Just this payday alone, they hit me with $210.00 in NSF fees including a fee for their fee. I know a bank has to make money to pay for their employees, but why rob their customers to do it? I am so stressed about this and financially put in a bind.

On October 19th, I logged onto the Capital One website to check my account balance. I was surprised to see that I had a negative balance when I was expecting around two thousand dollars to be available. Thinking it was a simple electronic error; I went to the local branch by my office building and sat down with a "relationship banker" named Jerry. He told me that it looked like my mother's account was overdrawn and because her name is on my account, they took the money she "owed" from my account, approximately $1800.
After speaking with my mother, I learned that she had closed her account and opened a new one with Capital One. A debit must have been pending during that time when she was in the process of closing her account. I went back to the Capital One bank with a print out of my most recent statement to get further details as to what happened and why I wasn't notified.
Jerry was busy helping someone else so Linda ** helped me. She told me that $1300 was originally taken out but was then returned (which I knew from my statement) but that my mother did in fact owe the bank in the amount of roughly $1800 and that was taken out of my account because her name is also on my account (which I opened with her when I was a child and have kept for over 20 years). Linda then advised that I close out my account because that was the only way to take her off of my account to avoid this happening again. After accepting the fact that I was never going to see my money again, I decided that I would close out my account that Friday, October 22nd once my direct deposit pay check had been deposited. On that Friday, I walked into the same Capital One bank, saw Jerry, and told him I was there to close out my account. He pointed to the teller.
I walked to the teller and told her that I was there to close out my account. I filled out a withdrawal slip and was given the balance on my account in cash. I asked the teller, "Is my account now closed?” Her reply was "Yes". Once back to my office, I went on a few websites to cancel any auto-payments that I had linked to the Capital One account. I was able to cancel all but one, my car payment through Lexus Financial. On the following Monday (October 25th), I tried to cancel the payment again and add my new bank account information. I saw that the current payment was being processed. I called Lexus Customer Service to see if they could cancel the payment. They said they could not because it was in progress but that if the account was closed, it would get bounced back. I then logged into Capital One to make sure that my account was indeed closed as the teller had told me it was on Friday.
In fact, it was not. It was still active. I was concerned that the payment would go through and then I would be in the same situation that happened to my mother where her account was overdrawn and she owed the bank. I called Capital One Customer Service. The woman I spoke to told me that she can put an immediate close on my account because what actually happens is that if the account stays a $0 balance for 5 business days, then it rolls over into "closed" status.
This was not what the teller had told me. The customer service rep then said that she was emailing the department that is in charge of closing accounts and assured me that they respond immediately and all it would take is for them to open her email and take action. I asked her if there was a way to put a hold on my account so that nothing would go through in the interim. She said no but that she had already sent the email and my account should be closed shortly. Not satisfied with leaving this up to chance, I went into the same Capital One and asked to speak with a branch manager.
I spoke with a woman named Seema. I explained to her my situation and requested again that my account be immediately closed. She put a hold on my account so that the Lexus payment would not go through. She put comments on the account that said not to put through any transactions as the customer has requested that the account be closed. She assured me that she would check every day and calls me when my account was finally closed. This was yesterday, Monday. Today, Tuesday, October 26th, I checked my account at Capital One again, the Lexus payment is being processed and from my view, my account says it is negative $643.37.
I went to Capital One this morning and spoke with Seema. She told me that she would call the branch where this transaction was being processed to find out why this was happening since there was a hold on the account and notes to not process. After speaking with the manager at that branch, Seema told me that because it was an "opt-in" payment that there is a chance that they cannot deny the payment and it will hit my still open account. But I have to wait until tomorrow to see if the payment gets fully processed.

I had two Capital One credit cards with a $200.00 limit and had Payment Protection Plan coverage on both cards. I became ill with numerous health problems and was unable to get a doctor’s release to return to work. All of doctor said was that my health problems were too numerous to repair and releasing me to work was too much of a liability. I was also refused by the Texas rehabilitation commission; they said in reviewing my medical records that even with rehabilitation I was permanently disabled and would never return to work.
Capital One contacted me and stated that I owed over $1500.00, but they would work with me settle for $501.00 and have it removed from my credit report. They said that on the one card they did not have a record of me filling out the required claim; on the other card, the first payment that was due on the Payment Protection did not apply since I got sick before I sent them the $501.00 via Western Union. The cards are still listed on my credit report.
I am out the $501.00 plus interest. My credit applications are being turned down because the cards are a black mark on my credit as a charge-off. This had to be done right then or the offer would be withdrawn, so I was out in the middle of the night trying to find a Western Union representative to get a money order and confirmation number, then call the Capital One representative back with the confirmation number.

I am a quadriplegic. I went to CheapTickets.com to purchase for caregiver's daughter (Guadalupe). A day later, I find out it's the middle name (Vilma first). If you go in site (booking ticket), you see: they provide opportunity to ''change traveler's name''. When I tried, they want extra $200.00. I said no, same person. I bought another ticket through American Arlines (same card/person). I notified Capital One. American Airlines said, "She's not flying, fix this!" I paid everything I owed. I returned the card and Capital One says, "Wait until Amber bills you." Now, there's a problem.

They let you charge over your available credit so they can collect fees and they get some kind of pleasure doing this. No one there speaks English, which makes it impossible to fix anything. They let internet companies commit fraud on your card and they won't close your account. I don't understand why they get a B+ rating when there is over 9,000 complaints out against them. Will someone explain this to me please? How can they be rated the #1 card to have in your wallet? What is happening to America?

Capital One has called me 29 times in three days; earliest was 7:30 pm on a Sunday. I finally was able to pick up and they told me I was four days late on a payment. I paid, and again the phone is nonstop.

I have cancelled this credit card back in 2008 and 2009 by phone when I received the credit card. Then in 2010, I received the credit card again and called to cancelled again. They threatened me to ruin my credit if I didn't pay the annual fee. I refused to pay the annual fee since I cancelled it. I am now stuck with a ruin credit rating because I'm in war with this stupid people at Capital One credit card. I did pay in full in balance 2008 and 2009, then cancelled. It seems they're not listening. Should I write lots of letters to force them to cancel the credit card if I go to a lawyer?

I paid the credit cards settlement in Oct. 2006. After 4 years, I received letters from Cap 1 saying I owe them money on two cards. I did receive a final settlement letter from CC but I do have proof that I made payments on these accounts as agreed with Cap 1. They are refusing to update their statements on my credit reports and are dating these charges with a 2010 date. How can I get help? Who can I contact?

I retired from being an LPN in 2007. I was made totally disabled in 2008 due to I have COPD asthma, degenerative spine disease and anxiety attacks due to breathing problems. I paid for this protection. I was under the idea that my protection would pay when I could not. I attempted to work but had to quit due to breathing problems. I live on a small pension and cannot make the payments. I am on seven breathing problems and was hospitalized in February 2010. Please help me.

I currently have a credit card debt of just over $700 with Capital One. This, I accept. The account is delinquent, and they would like me to pay off this debt. This, too, I accept. Capital One has multiple call centers to deal with its expansive customer base. Again, this, I accept. They like to call periodically to see when I'm going to be sending in a payment next, and how much it will be. This, I begrudgingly, tolerate. There is a limit, however, to just what I will tolerate.
For the past month, it seems that I have been getting an average of five calls a week, sometimes as many as four a day from Capital One. I have repeatedly told them my situation, and asked them to make a note of it in their system so that the next person scheduled to call me can see that I can't make a significant payment at the present.
However, it's almost a sure thing that I will get a call from someone asking to speak to me to set up a payment over the phone. Not only have I repeatedly had to relate my situation, but I've had to repeatedly tell them that I can't make payments over the phone. I have no bank account, or any other method of sending money electronically. I have asked them repeatedly to put that in my notes; and occasionally, whomever's calling me will actually say that they see that fact in the notes.
Also, I said before that I can accept that Capital One has multiple call centers. However, it gets redundant, annoying, and more than a bit depressing, to constantly have to say that I'm effectively broke, and can't honor my debts at the moment. Recently, they have tried the tactic of asking if I have a friend or family member that can lend me the money. I tried to point to them the glaring flaw in that plan--being that I may have CapOne paid off, but I still owe $700 to someone else--to which they reply, I assume as an attempt at humor, that the person I borrowed the money from won't charge me interest. True, but it's still $700. No one I know has $700 they can part with for any considerable amount of time; a fact which I have had to explain every time the subject is brought up. Besides, creating a new debt to pay off an existing one is redundant and outright stupid.
CapOne has also tried the quasi-threat that if I don't pay something soon, the matter will be turned over to a collection agency which will damage my credit report. Well, you know what, my credit report is the least of my worries at this point. If I had to come up with $700 to keep my car from being repossessed, I still couldn't come up with it. The simple fact that I don't have $700, nor any conceivable legal means to get it, just doesn't seem to be getting through to the faceless voices on the other end of the line.
To that point, the operators at CapOne seem incapable of breaking script, or even thinking on their own for that matter. They are, I assumed, trained to rigidly follow their script, and to treat any divergence from said script or acceptable answers as wholly unacceptable. And if you try to interrupt them, they simple plow on with their rhetoric, forcing you to yell into the phone to get them to stop and listen to you. And no matter what any of them say, they do not care about you. The only thing they care about is getting the money owed to CapOne.
On a side note, I had a Payment Protection plan that I paid for on my monthly bill. This is a plan for--if I were to be laid off or unable to work due to disability. However, while working, I was only making enough to where I could send them from $5 to maybe $20 dollars a week; which was not enough to counteract the late fees and interest. However, since I was employed, Payment Protection could not be activated.
When I was laid off, one of the first calls I made was to CapOne to activate my PayPro benefits. It seems, though, that because my account was delinquent for a specific number of days, PayPro benefits were suspended. How fortunate for them that the cutoff mark was less than 24 hours after they charged me for the service. They initially told me the number of days before the service would be suspended, but then changed it after I called them out on the fact that it would've meant that they charged me after the suspension date.
They quickly corrected themselves, and said that the first figure I was given was a mistake. Of course, it was. You know, in all the calls they made to me during the past months, maybe they could have mentioned the upcoming suspension of my PayPro benefits. But no, the terms I agreed to would have told me all I needed to know, according to them. Maybe, but how could I have predicted that the situation would arise where I was uneligible due to work--but not making enough to keep the suspension from happening?
CapOne, as a company, of course, is not required to do anything more than the bare minimum. They don't have to be lenient, they don't have to care, and they don't have to be helpful. The only thing they have to do is abide by the law, which is why, of course, they have such long, wordy contracts. They detail everything they want to be able to do, and bank on the potential cardholder to either not read, not comprehend, or not know how to amend the contract before signing. In truth, I don't think there is a way to amend the contract before signing. If you don't want to sign, they'll find 10 other people who do. I think I'm starting to lose the point here, so I'll sum up.
CapOne will not work with you on your debt unless it involves them getting money on a regular basis. They will not allow for the fact that you barely have money for food or lodging. They want their money and, to be honest, they are entitled to it. Just don't expect anything less than five calls a week from a different person every time until they get it.

I have had Cap One for some time now so my purchasing history should be well established. The called to look at fraud but they mentioned an electronic purchase and a music purchase, both of which are common. They failed to flag an Asian dating services and flowers to China! Going through their fraud department I have never spoken to the same person twice. I was paying it off so I could close and thought I had scheduled a payment but could not see it on the computer as a pending payment. They ended up taking out 2 payments and have $1200 of my money that I can't get back for better than 2 weeks! Yeah, Cap One is toast. Chase called me within minutes of a purchase of airline tickets with a card I had there (this card is only used for my mom's pharmacy and a onetime use for durable medical express which turned out to be the source of the theft).

Received a credit card offer from Capital One, got 300.00 credit limit was raise to 1000.00 after paying on time. Fell into hardship, could not make any payments for a 4 year period. Then I was sued by Capital One for 7000.00$ and am make 150.00 a month payments have documents to prove it.
Could not afford to get my wages garnished or my car taken, so I agreed but feel very robbed over this! How can I owe a company a 1000.00$ and get squeezed for 7000.00$ through the court system. Someone please help me. I will fax all my documents if needed please! Nobody cares!

Capital One does not list any promotional end dates under your account details online and/or on monthly statements. I unfortunately missed the end date by a month and they are unwilling to waive the interest even though I paid the balance in full by the following due date.

I settled in court with Capital One who stated they lost two checks of mine and then paid my bank stop payment fees. Then the two checks that they claimed were missing, which I eventually replaced to pay them off, were deposited into my bank account after several months and were cashed totaling $1,000.00. I did not authorize or have knowledge of this.
I have given their lawyers time to settle this out of court and would like to be reimbursed the full amount of $1000, but their attorney played cat and mouse with me today only offering $970.00 back which does not cover the $1000 they took and overpaid themselves with.

I had a credit card from them and was paying for protection fee so that if anything happened I would be covered for a few months. Well, I happened to lose my job a year and half later and when I called to place the protection on, it was never applied and Capital One kept adding late fees and penalties to my account. My limit was 500 and then went to 700 because I always pay my bills and now I'm being told I owe 1,400 dollars. I am now back to work and cannot pay that amount and don't feel I should have to. That's what the protection plan was suppose to do.

Both on the phone with customer service and in my bank branch office, I am being told that all this information is a matter of public record and is simply being used to verify who I am.
I feel these questions are an invasion of privacy and are none of the bank's business. I am told I cannot have access to my accounts online unless I provide the correct answers to these questions, which at this point, I refuse to do. In addition, someone I know was also frozen out of her account. She called Capitol One and with the most basic of information was told what her username and password were, and talked through the log on process with that information. Yet I cannot do the same.

My biggest fear: I am going to have to find a way to sue these folks for fraud or else wind up being 'pooled' as 'performing' in some sort of 'Resolution Trust' liquidation of the GSEs and have all rights to recourse extinguished in the process; My second biggest fear is that if I sue (MD or VA), the terms of the mortgage trust seem to say it's a callable Virginia default; My third biggest fear is that any action will drain what very little I have managed to set aside for retirement, leave me on the sidewalk with a shopping cart and hounded for the rest of my life.

What hasn't happened with these thieving **? In the beginning, since opening this credit card account in September of 2006, I have been fighting this company's incessant urge to constantly invoke fee after fee (usually for things that are not and should not be my responsibility). And I am fighting tooth and nail or going out of my way just to get basic information about my transaction activity that should be readily available to me by my own means of access.
Meaning, I should be able to log in to the website or look at a printed statement and see that information--rather than take time out of my day to call in, sit on hold for 45 minutes, just to have them look up the information for me that I could just as easily have looked up myself in the same two minutes--minus the hold time on the phone! Which I could do, if that information were only included in my account details like it should be in the first place!
My issues against Capital One are many, so forgive the length of this complaint:
1.) Fees and Spending Limits
First of all, I believe that if you are given a spending limit, you should have free access to every penny of that limit to spend for purchases or whatever the client chooses to use the card for. But the reality is, especially with Capital One, that just isn't possible. Because of the high interest, and the "Account Balance Coverage" (ABC) insurance premiums," one must "set aside" a certain amount each month to cover these charges, or incur the over-limit fee of $29.
The ABC insurance premiums, which I was not told, and found out only just recently, were optional! In fact, I was actually told in the beginning that they were mandatory, because I did ask what the ** "Account Balance Coverage" was! I would have canceled the insurance sooner if I had known that it was optional, but after paying into it for four years, I decided it would be a waste to essentially throw those paid premiums out the window and lose that coverage which might actually come in handy, especially at the rate these jerks are pushing me into a situation of being unable to pay off my account balance.
So, my current limit is $2,000, but even after getting a lower interest rate and adjusting my ABC premiums to a lower rate, I still have to make sure that $35 is available to cover the interest and insurance premiums. So, out of a $2,000 limit, in reality, I only have $1,965 to play with. If I want to spend all the money that is "available" to me, I got to have another $29 to cover the overage caused by fees and premiums charges!
In order for me to honestly have the full $2,000 at my disposal, I either have to rush out and make a special additional deposit of $35-$40 to be available prior to statement date when the interest and premiums are charged or Capital One should not charge me over-limit fees for those charges causing me to go above my spending limit.
Fees, premiums, and interest should be made exempt from over-limit fees and penalties, because the client has little control or predictability over that. Most other banks and credit card companies only look at what your balance is, at the time the new statement is being drawn up. If you are over at that time and that time only, then and only then do they ding you with their fees. Anything that occurs between statement dates is not held against you. This has been my experience, at least, when I was a secondary cardholder on my mother's account with her bank, when I was first learning about credit and financial responsibility thereof.
But what does CapOne do? They have their computers set up to keep a strict watch on your account activity, so if you go over limit by even a penny, even once, smack-dab in between statement dates, they still hit you with over-limit fee! And God help you if by some fluke of timing, of payments versus charges being posted, should cause you to go temporarily over-limit for but a few minutes or just a day or two. And more than once, you'll be dinged $29 each time you go over. Can we say "cash cow" for these greedy **?
So, it doesn't matter if I make a purchase. And it doesn't matter if, as a precaution and gesture of responsibility for my spending gamble, I simultaneously send an online payment to CapOne to cover the potential overage because if the purchase transaction happens to get posted first, the payment gets posted bringing me back down under-limit, that doesn't matter. CapOne catches that, and seizes the opportunity to rip me off for an extra $29.
Then, there's the "Annual Membership Fee." What is that? What am I a member of? The ** society? $59 every year, and what makes this so bad, is these idiots do not have the courtesy to give you a heads-up notification by mail, email, or phone call, to let you know that an additional $59 will be charged to your account soon. And thus, allow you time to make arrangements to ensure you have the funds available, so as to avoid going over-limit and avoid the fee! But that's exactly what they want to happen; to ** you not only for the "surprise" $59, but also to justify tacking on another $29 fee for "you" going over-limit.
I could mark my calendar, but what if I forget to check it as the date draws near? I could put a post-it on my computer, but what if it falls off and I don't notice, and it gets lost? I could do a dozen other things to remind myself, but I got a million things to worry about that are a little more pressing than something that happens once a year. I tell you, I got a hard enough time remembering certain re-occurrences that happen daily, much less annually.
It shouldn't matter what I do or don't do to remind myself. The point is, I do not think it's too much to ask that a little customer service be exercised, and a customer get a "friendly reminder" that can only serve to assist them in keeping them within their limit and avoid unnecessary fees, and in turn avoid any additional blemishes on their credit history! They have no problem "reminding" you about their latest promotions, or that you owe them money. So what's one more "reminder"? Oh, right. I forgot. It's not going to benefit them to remind you to be prepared for an annual charge coming up that will eat up your available credit and potentially put you over-limit.
2.) Lack of available detailed account information
The other issue is the complete lack of information about my purchases that ought to be available to me at all times; thus, accessible at my leisure. If CapOne is going to charge me more fees for shopping outside of Canada (2.5%), then they better ** well show me.
- The source amount in the currency of the country I purchased from;
- The exchange rate in actual dollars and cents because I do not have time to mess about with a calculator figuring out what the 16-digit decimal percentage figure means in monetary terms;
- and how much their stupid rip off fee of 2.5% is, again, in dollars and cents, that they punish me with for shopping outside of Canada, making them have to actually do something resembling work, by calculating the foreign currency conversion.
But no, they make me, once again, take time out of my day to make unnecessary phone calls, sit on hold for 45 minutes, and have them look up information that I should already have available to view online in my account's transactions details. The most recent grievance is with "Account Alerts." After many suspicious charges made to my card, I set up the alerts to notify me of every piece of activity that occurred on my account--be it charge, payment, or account balance or available credit updates.
I set up the alerts in November of 2009, and I was getting them like clockwork. And they did, in fact, allow me to find out about many unjust charges made to my account, which gave me the time to investigate and have them dealt with in due time before it was too late. This was all good, up until recently (October 12, 2010), when my last two transactions did not produce alerts to my email as per usual! And oddly enough, only the charge alerts did not come through! The others alerts for balance updates, available credit updates, and payments posted--those came through, but for the charges made against my card, nothing!
What kind of shady business is that? I checked my alerts settings online to find nothing was amiss; nothing was reset nor set incorrectly, except for the discovery that there was suddenly a "minimum limit" imposed on which transactions would prompt alerts--only transactions greater than $20! So, what that means is, I won't be alerted to anything charged to my account if it's under $20? And if there were any suspicious charges, I would never know! At least not in due time!
Over time, these charges would add up! And I might think it's just CapOne imposing some fee or other charge that I am not aware of. But in reality, it's just "legalized robbery," all because they can't be bothered to let me know of transactions less than $20! I am supposed to sit back obliviously and risk losing money everything because CapOne cannot be bothered to allow customers the right to choose how to monitor their own account activity and just be in the know, in general.
When I have transactions pending, then yes, I do keep a very diligent and watchful eye on my balances. I logged in often at least once every day, if not several times per day, so I can get the latest information to update my own personal files with. And I do this until the last transaction is posted, at which time, I feel that I can relax and slow down on the constant "checkups," and feel secure that my account will not have more (unauthorized) charges made to it. But if it does, then I would like to have the peace of mind to know that I will be alerted, regardless of whether it's for $19.99, or for a lousy nickel!
Because either of those amounts, with the way my balance is these days, could very well ** up a lot of things for me, resulting in over-limit fees, and general inconvenience while I wait for these funds to be retrieved and returned to my account--waiting longer still for the actual process to execute and have it all reflect as it was before the whole thing began! These idiots cannot appreciate that funds getting needlessly tied up like this is a huge inconvenience for me! And they're completely preventable, or at least they can be minimized as to how much time is wasted on undoing what should never have been done. If only I were alerted to the charge as it happened! And not two weeks later! All because CapOne cannot be bothered to value the customer's right to be alerted to any and all activity made to his account!
Whether it's an ill-gotten charge of over-limit fees to my account that I am trying to have reversed, and accessible by me in my online account without having to waste time on hold over the phone for nearly an hour, I am getting jerked around by the inept levels of professionalism and complete lack of common sense put forth by many of the employees of CapOne.
Be they the common Customer Service Representative, of someone of higher rank, such as Accounts Supervisor or the like, more often than not, I get complete idiots who do not know how to listen to what I have just clearly told them--nor do they know how to think for themselves and help me with a satisfactory resolution to my problem or concern that I called in about. And when I asked for these policies to be explained to me as to why such stupid, nonsensical policies exist, all I get is the basic "because I/we said so" mentality, as well as more stupidity and more policy--this just infuriates me even more!
I am so sick of Capital One, and their lies, their shady "policies," their fees, their incompetence, their negligence, their refusal to comprehend simple logic, their constant mindless adherence to policy and complete disregard for the customer and his/her satisfaction (in terms of them having full access and knowledge of information pertaining to their transactions and other account activity at all times), and complete lack of options when it comes to account management!
And not to sound racist, but I am also sick and tired of their "import"/outsourced c/s reps who can barely speak/understand English, which is where much of the problem lies when they do not "listen" or cannot comprehend what I clearly explain as my concern/issue! Capital One needs to be investigated thoroughly, and forced to comply with more customer-friendly policies that serve the client/customer! Not the greedy, sneaky, underhanded corporate snakes who are just looking out for their own bottom line! They rightly ought to be run out of business--they have no business being in business!

For the la t 2.5 years, I have been laid off from my job after working in the concrete business for the last 14 years. I was laid off due to the lack people and business not building homes and new business and the recession. I filled out Capitol Ones paperwork for involuntary employment insurance and tried to get benefits. I was told I would receive the 20.00 minimum payment and they now say I owe 1,653.33 on a $750.00 line of credit. I just spoke with Dexter from the MRS Collection Dept who took the account over and he calls and harasses me at work and at home over a credit card bill I can't believe doubled. Dexter also told me that the limit was raised to $1,000.00 and some point in which I never authorized.
We need help with all of credit card companies that have charged us for a benefit that of debt protection and it's not my fault we're in a full blown recession. I'm in debt up to my eyeballs and 3 Children and 1 handicap 13 yr old daughter with a rare disease.

I have chosen this card sometime in 2008 to accumulate rewards because it did not have any fees attached to it. Fast forward to 2010. I have accumulated 34,000 miles and now I am being told that there has been a revision to my account and there will be a $39.00 yearly membership fee. The same rewards program is available for free for new sign-ups. I have been told, "You can contact the credit bureau to obtain more details about the reasons related to your credit report."
Basically they are telling me that the increase is due to my credit report, which is vague and I do not believe it. I have never incurred any interest charges or late fees with Capital One as I pay my card in full every month without fail. I also do not believe my credit report will reveal any problems. It is my opinion that this is another deceptive practice that penalizes the responsible customers, which the credit card companies do not earn income on by charging interest or late fees. I have canceled my account and cashed in the rewards for half the value of which I earned. When I questioned the fee the part of the initial response was, “In order to avoid the fee, the account can be closed."
These are deceptive practices. The program I had joined would earn 1.25 miles for every dollar spent and was fee free. The program that earned 2 miles for every dollar spent did have a $39 yearly fee attached to it and I did not choose this one. Cashed in my rewards value for 1/2 their value. I had the intention of using the miles to buy a ticket overseas and will be unable to due to their unfair change in the fee structure.

This company is shady at best. My husband and I have had two Capital One cards for years. We have had numerous issues with getting our statements. I call, they tell me to confirm my address; I do, they say that is what they have, but no statements. So, I set up and account online, not getting those either. Hence, I have had to pay late fees since according to Capital One this is my fault. I called in again today and was told to give my address. I gave the wrong address on purpose and the lady said, "Yes, this is what they have." ***. Unreal.
I proceeded to tell her this was the wrong address and she said it was my responsibility to put the due date on my calendar to remember to pay it on time. There was nothing she could do to help because they were sending out statements like they were supposed to, even though they never arrive. I am paying off these cards asap and never want to hear about Capital One again.

Capital One filed a 1099-C in the wrong tax year compared to when the last payment was made on a Visa account, and when the company chose to charge off the debt. They then sent the 1099-C to the wrong address so the first notification I received was from the IRS saying I had failed to report income. When I attempted to obtain the account records from Capital One, it took days on the phone to get to the correct department.
When I finally reached the recovery department, the representative was rude and gave me false information regarding the collect-ability of debt. I finally received the information from the rep that I needed to request the account records. I mailed the letter to the address the rep gave me with the request for all account records. I received a form in response requesting the same information that I had provided in the letter. I completed that form and mailed it back. I finally received something from Capital One - a copy of the 1099-C. I did not receive any records. I have still not received any records. I finally called the corporate number and the switchboard connected me to the tax department, which of course only handles the corporation's business taxes.
I still have not obtained any records on this account and therefore cannot prove to the IRS that the 1099-C was filed for the wrong tax year and that I likely do not owe the additional taxes either because the 6 years in which to leverage the taxes has passed, etc. So the time I have to contest the tax assessment is running out and I can't get cooperation from Capital One!

Since October of 2008, my husband has been unemployed from his full time job. He has had odd little part time gigs but his full time career is dead due to the economy and the nature of his business (electrical/mechanical engineering). I called Capital One back in December of '08 explaining the situation, looking for help. They offered none, were rude, told me " too bad" and asked, "Are you going to pay or what?" They offered me a payment plan to " help" me, that was higher than the current monthly fee that I could not afford. When I told them this, they said there was nothing we can do.
I have been a customer since 1998. After many, many battles, I am now in a debt mediation program, aka suing Capital One, as they are trying to sue me. After a nasty battle, my attorney reached a settlement with them but sneaky jerks that they are, they put through a court order to enforce a levy against my checking account and claim that although this was settled before the levy was to be activated, they did notify the court officer (they did not) and oops, they are sorry. There was not a day that I came home from work, where there was not some snotty, mean, threatening letter from their "attorney" with court dates and a bunch of other crap.
Now, after they put the levy on my account, they actually sent me another document, claiming I violated the plaintiff's request. All this after the settlement was reached for approximately half of what I owed. Capital One sucks. They are a bunch of sneaky, conniving, greedy jerks, who don't care what bad luck has fallen on to any of their customers and they are not willing to work with their customers. In fact, they seemed to force their customers into either a debt mediation program or bankruptcy and they still continue to harass, upset and rattle their customers' nerves.
Capital One, you truly are an evil credit card company. You don't stand behind your customers and you don't seem to pay any attention to legal issues. They prey on their customers and I am sure have scared many of them into making payments that they probably can't truly afford. I will never, ever, have anything to do with this company or any of its affiliates and I will be sure to share my horrible experiences with anyone who cares to ask. I am also considering filing a complaint with the attorney general about them. Capital One sucks. Stay away. They are truly a ruthless, evil company.

They are charging customers interest rate for the annual fee. Below, I have included excerpts of my email conversation with Capital One. Do you charge interest on the annual fee?

When you make a purchase on your credit card, you have the option to pay off the balance in full each month or you may carry it over to the next month. When the balance is carried over to the next month, you will be charged interest for the unpaid balance. If a cash advance or special transfer is made, interest will be assessed as soon as the transaction applies to your account.
I understand paying off the unpaid purchase balance but there was an annual membership fee. I should not have to pay interest charges on a membership fee. This is not legal and I am requesting an adjustment on the interest charge.
Thanks for contacting us about your Capital One account. Good news! We've credited your account for $6.70 in interest charges. You'll see the credit on your next monthly statement. I would like to know if Capital one did this since my account was opened. If so, I am requesting you reverse the interest charges on all other annual fee charges obtained since my account was opened.
Unfortunately, we are unable to waive the finance charges that were assessed on your account.
I will be reporting this information to a government agency and the BBB. This is considered to be fraud. An annual membership fee is not a credit card purchase. It's a required fee you charge. It is unfair to recoup interest rate monies from customers off of an annual membership fee. It is in the interest of company to be fair to the many customers you have. I am suggesting Capital One reverse any additional interest charges for annual membership fees. In your previous email, you stated you would reverse the interest rate charge for the annual membership fees. When I request you do it for any additional years, I am told it cannot be done. I have been with North Fork bank for 30 years or more. In May of 2010, I started a refinancing process with Capital One. They have closed the old North Fork loan facility on Long Island and moved everything to Dallas.
I worked diligently with Dallas for five months and received an offer to refinance my New York City condo. However, that was reversed because the original underwriter left the bank. I have a lot of depreciation from commercial properties and the new underwriter reuses to consider this depreciation. The irony is that the existing loans are from North Fork bank who underwrote the income considering the depreciation.
They had three appraisals on the condo and spent months on this. They refused to discuss the income with my accountant. I have huge monthly payments which I am current with but would like to reduce with the lower current rates. These clowns have no idea!

I have been through the process of applying for a new Capital One Venture Credit Card. I was immediately approved over the phone, but have had a horrendous time talking with customer service since. The initial application was the only time I spoke with someone who could speak proper English. I had a very hard time understanding their customer service personnel, nor were they helpful at resolving my issue. They have a limited repertoire of responses they can say and it’s actually humorous to listen to their responses when they have nothing to do with your questions.

On September 10, 2010, I contacted Capitol One about paying off my account in one lump sum, and they agreed. I had to sell my car but I did and paid the $4,000 settlement. I thought we were all done. I had done all of this because I was going into the hospital for some heart surgery. Frankly, I did not expect to live, but I did. I am home now and the first thing I found in my mail is the bill from Capitol One. Oh, they took my money but claim they didn't agree to the settlement. How convenient! They say they have no notes for the 10th of September. I'm not the one hiding behind a recording system, they are. Now, lo and behold, they say they never agreed to any such settlement.
I am negligent only in the fact I do not have a system to record a telephone call like Capitol One does. I am now disabled because of one stroke and two heart attacks. Obviously I am unable to work. Capitol One demands payment in full and claims that the person I talked to didn't bother to annotate the phone call properly. And now, I am certain they will very conveniently claim not to have the call on file. Isn't that a very convenient out and another way to ** the customer? On top of that Capitol One very conveniently to them and just as inconveniently to me has repeated changed the interest rate, changed the due dates and increased the payment frequency, all without giving any consideration to me. Capitol One does not care one whit about any of their customers, only increasing their profit margins.
I paid the $4000 to settle the account in full. Capitol One now contends they do not have to honor any such agreement. Fine! To the rest of America I say, "Do not do business with these people!" They'll stick it to you at every turn. Funny though, they didn't mind taking the billions of dollars from the government which was supposed to help take care of situations like this. One last word of advice. Never do business with an outfit like Capitol One, because if you do, you'll be used and abused and walked all over, like I did. I will survive somehow, but I will never trust Capitol One again! Neither should you!

I used a 0% for a year offer and when my Statement came in, it showed my whole payment applied to the 0% offer and nothing to the regular balance. They even added the 12.xx in interest to the reg balance. In Aug/Sept, the purchase was $793.52, the interest was $12.06. In Sept/Oct purchase was $805.47 which is $793.52+$12.06. My $60.00 minimum payment didn't even pay the interest?

Capital One closed Greenpoint Mortgage and they started servicing my commercial mortgage loan. Their 2 numbers for customer service never works. 888-959-4462 always transfers to a full mail box. Their 866-788-5649 transfers to a call distribution group that disconnects the call right away. My actual problem is that they collect 10% more in my escrow account on an initial $2800 mortgage. I pay $1800 extra every month for my tax bill, which is $824 (Insurance is paid by me directly). This resulted in collecting over $13,000 of extra payment in my account. At the end of the year, they issue a refund. Is this legal? No other lender has done this to me.

After a few months of his account going delinquent, they began to call me on my cell phone, even though I had never given them my cell number. When they called, they asked me did I want to make a payment and I said, "No. We are not together and I am not responsible for the charges."
On September 30th, I checked my bank account only to discover a $608 debit by Capital One. I nor my ex-husband authorized this charge. I called Capital One and my ex called as well. We received two separate stories. They told him I was no longer on the account and someone used my checking information. They told me I was still on the account and my ex authorized the payment.
When I looked at the check they drew against my account, it had his name and address on it, no signature or anything. My bank also told me that the check number was invalid. When we both spoke to a representative, they could not explain how my account was charged or who authorized it. On 10/5, they promised to debit my account back. On 10/7, I called to verify this was done, and they still hadn't processed my request.
I find this to be appalling and unlawful behavior. I also have my own separate Capital One Credit Card and Auto loan. I would go as far to say that they looked up my personal information on my accounts to use against my ex's. Capital One unlawfully took money out of my account to pay my ex's husband bill and the money they took was meant for rent. Now, I am in jeopardy of being charged a late fee and an overdraft fee due to insufficient funds.

I opened my Capital One card in 2009. I used it faithfully and paid every month on time. I had no problems with Capital One or their customer service until October 2009. In August 2009, I became ill and spent a week in the hospital. On 15 August 09, the day I was released from the hospital, I was also laid off from my employment. I tried to claim unemployment; however, the state fought my receipt of it, until December 24th, when I received my back pay.
Two weeks after I was laid off, my husband was also laid off of work. His company denied his unemployment and we are still in pursuit of the back pay. My husband and I went four months without any income. We had no savings so we had nothing. We went into "survival mode." We had two major credit cards, and we began to use those for gas (to look for jobs) and food to eat. We could not even pay our mortgage, car notes, insurance for the vehicles. By October, we had maxed both of the credit cards out at their $500.00 limits.
I called both credit card companies and told them the situation--that we didn't have anything to pay them. What could I do? We didn't have jobs and there was no way to pay them in the near future. They told me to just wait. Meanwhile, Capital One sent me numerous statements with increasing fees. Two months later, the monthly minimum payment was well over $100.00.
I called to cancel the card and see what I could do. I was directed to the collection company, who told me that without paying the minimum payment, there was nothing that they could do. The interest would eat my payment and it would be that much more the next month. With my head spinning, I couldn't figure out what to do. I tried to call and talk to another person and received the same comments.
We eventually began to ignore the phone calls from the collection agency. Then, we both began working again full time--my husband in March and myself in May. I called the collection agency back and told them that starting in June, I could begin to make $50.00 payment. At this, time the balance was already over $900.00. I was told that if I didn't make the minimum payment today, at a little over $300.00, then it would be written off my credit (the worst there is).
I told the man that I didn't have that money (at that time, I didn't have any money to my name), but next month, I could begin the $50.00 month payment plan. He told me not to bother--without the minimum payment being made, it was useless. He would not setup the payment plan with me. He told me that any payment I made that was less than what he was offering would not be accepted because it wouldn't affect the balance. He also stated that he couldn't stop the interest even though I had repeatedly asked for the card to be closed.
I now have a payment plan of $75.00 every month, with a balance of over $1,000.00. That is more than double what my credit limit was. They have been the rudest and nastiest people to deal with. They were very degrading in the respects of how they talk to you. The other major credit card that I had at the time, their balance is considerably lower than the Capital One with the same limit and same balance in October 2009. They also suspended all fees and interest at the time I asked for the card to be closed.

In 2002, I opened a credit card with this company with a balance of $500. I had move to another part of the country and was not able to find employment and the card was sent to collections. I have been working on improving my credit but last year, I lost my job again and today I received a bill from Capital One for over $6,000.
When I called, they said they reissued the bill due to the recent credit card law that went into effect. So now, I am unemployed and have a raging $6,000 bill. I didn't expect and can't pay! Can they do this? The APR is up to 25.900%. They accrued the interest since 2005 when it defaulted. The balance subject to the interest rate is only $685.03. I don't see how this new law can possibly help the consumer.

On September 14, 2010, I requested a balance transfer from one credit card to my Capital One credit card. I did this because of "unbeatable" offers I received from Capital One. After about a week, I noticed that the amount had been transferred to my Capital One Credit Card but the payment had not been posted toward my other credit card. During which time, I was incurring late fees/penalty charges as well as finance charges from both institutions. So I contacted Capital One to explain my concerns and asked why they had not processed the transfer. They told me that they take 7 business days to process these types of transactions and that I would need to wait another week and then call them back. I then asked them if they could at least take a moment to review my information to make sure that everything was correct (my name, address and account number). They politely refused and asked me to call back later.
One week later, I phoned them again because still no activity had happened on either account. After being transferred numerous times, I finally reached another rep who, again, took all my details and with whom I expressed my frustration at this point. After reviewing my account, it was concluded that the reason my accounts had not been adjusted was because they had the wrong account number. So the rep took down my correct information and updated my account and informed me that they were going to cancel the original transaction and submit a new one towards the correct account. The rep mentioned that this process would take a few days because they needed to place a stop payment first and then resubmit the transfer.
On 9/30/10, I went online to check both of my accounts and saw that everything had been corrected and both accounts had been updated. Now today, 10/6/2010, I checked my accounts again and it shows that the charges have all been reversed. I immediately called Capital One to see what was going on and they could not give me an answer as to what happened. They transferred me to various reps, again, until finally I was hung up on by a woman named "Olga". I called back and this time, spoke with a rep by the name of "Miles" who was unable to resolve my issue. I explained again that this was a great inconvenience not only for the time I am wasting calling them on their error, but for all the charges that I am incurring and the damage that it is doing to my credit. Miles ultimately said, "At this point, there is nothing that Capital One can do for you except wait 7-10 business days from yesterday 10/5/10 to give us time to process a new transfer". I told him that I did not think that this was acceptable and that I was very disappointed with their poor customer service. I am so frustrated and just want my issue resolved.

I tried to close two accounts with Capital One. The first method was over the phone. After repeated phone calls, I finally reached someone who could help me. After much haggling and arguing, I managed to close the first account and refused to pay any further interest fees. I had a zero balance and it had been closed by Capital One for non-usage. When I told the representative that I wanted to close the second account, he said that he had no record of it - lie number one.
When I got the next bill for the second account, I enclosed the payment stub as always, a check with the full amount owed and a note stating that I wanted to close the account. Unsurprisingly, I received a statement shortly afterward containing the note stating that they were unable to close the account because the full account number was not listed on the payment stub. For whatever stupid reason it never has been listed fully on the payment stub but that has never stopped them from processing the payment before. They also didn't return the check nor did they deposit it - it magically disappeared. I know they didn't want to close the account so they could continue to gauge me for interest payments (I managed to close several other accounts after the same hassles - it's a corporate policy with these usurious parasites).
So for the last three months, they have been sending me statements with increasing interest charges and late fees. They have also started calling me three or four times a day. I have ignored their phone calls for the most part. I have ignored their bills and I am going to file a complaint with the Texas Department of Consumer Affairs, and charge them for my time and postage and demand that they deposit the original check, minus the outrageous fees, and take that as the final payment. If they refuse to do this, they can turn it over to collections. I won't pay them either. I don't care about my credit report; it will absorb this and still remain good.
You have to fight all credit card companies tooth and nail to get them off of your back. I hope they all go out of business during this recession because a large part of it is due to their greed and obviously flawed business model. God help us all! My credit report is damaged; time and money was wasted on long distance phone calls; postage and time was wasted going to post office to file complaints.

They got me. They get a lot of us too. Huh! I am a small business. I got a little money happening and a good business going and through solicitation fell for the low interest. We're on your side. Let us help you build your business routine apparently. They raised my rate to 29.99% and charged me late fees when I know I sent them the money. 10 times more than the minimum but they say it was late.
I tried to switch to the Bill Pay and again they said my payments were late. I sent them a week earlier and still late. I was nailed by Capital One bank and they are suing me for 10 grand more than I charged. Forcing me to BK or pay for ever, to be a slave in servitude to them by court order for all time, accruing interest while earning monies unjustly. Hence, I do no longer wish to assist them in profiting and prospering any longer.

They absolutely don't care! Everyone I speak with keeps telling me that that's the way it is and I just have to pay it. I don't just have to pay for anyone's crime and I refuse to.
These people are absolutely heartless, the individuals I speak with and the company as a whole. They love robbing their customers blind because that's how they earn their paychecks. I had one fraud person say to me, "Oh, well, it's not that much money," and chuckle. I'm sorry but a few thousand is a lot of money to me and I'm sure to many others. Their people love to bully you into paying fraudulent charges. They try to back you into a corner and make you feel like it's your fault it’s occurred and therefore you're liable. It's not okay. And then they told me, “Well, we’ll take down the interest rate. We're doing you a favor.” You're not doing me any favors. Like I should feel gracious for them charging me a tiny bit less interest on money I shouldn't even owe. Really, how do these people live with themselves treating innocent customers like this? They are bullying me into paying $5,000 for fraudulent charges!

There is no credit card worse than Capital One. In the beginning, I would send checks to make payments and it would take 7-10 days to post to the account. Then I did bank transfers to make the payments. They would hold my money for a week before they would post it to the account. When I talked to them about it, they said it was their policy as they wanted to make sure the bank did not take the money back.
Funny, no other credit card company that I deal with has that policy. I always tried to pay it in full each month. I was charged late charges on more than one occasion. After the bank collapsed, they raised my interest rate to 37%. Any time I would call the company I would always get someone out of the country.
There is no worse credit card company than Capital One. I know another lady that was very responsible with her payments and experienced the same thing. As she stated they should put as much effort into taking care of their customers as they do in all their stupid commercials. Do not ever apply for a Capital One credit card.

I called to cancel my rarely-used Capital One credit card in August. They offered to waive my $29.95 annual fee if I stayed. I agreed. The rep thanked me for my business and offered to send me a new explanation of benefits for the card. I received that but noticed that the next month, the fee was still on the card. and the following month as well. When I called today to inquire about the fee not being credited, they said that they don't waive fees and that they can't find a record of my having spoken to anyone about it. They further informed me that it has now gone more than 30 days past the time my initial fee was charged so they won't refund the membership fee. Don't use this bank for any reason.

I have been with Capital One for 6 years and I have never missed a payment or made a late payment. They have proceeded to raise my interest rate by over double what it was for no reason other than, "the economy is bad." Recently, they started charging me an annual fee of $60 per year to continue having my card, stating "because of my credit score, they are going to start charging an annual fee." I feel used and taken advantage of and wouldn't do business with this company after I pay off my balance.

My husband was seriously injured at the time I owed Capital One a balance of $477. I was also laid off of my job. I had the Payment Protection Plan, paid for the service monthly. Then when the plan was needed, Capital One refused to honor it. This was to cover my payments in the case of loss of job, injury or death. I owed Capital One $477 in February of 2009. I did not pay my payments due to lack of income! I now, in October 2010, owe Capital One $1924 according to them and their bill is in the hands of an attorney now! There is no way to fight a company this large, what they say goes and the interest, the late fees, and the protection plan were a complete rip-off! Life happens, and we just don't always plan for a crisis!

I have been unemployed for 20 months and have still been making credit card payments to Capital One. I was late once and they raised my interest rate to 29.4%! I have been in contact with them the entire time and let them know I was going to be a little late but they raised the rate anyways.
How can this happen? I have been faithful in my payments even though I really needed that money for food and rent. There needs to be some sort of law against this sort of thing to protect the consumer. All the money I am paying them is going to interest only with about $20 going toward the principle. This is crazy! How will America ever get out of debt with this happening to everyone? No wonder so many people are filing for bankruptcy!

I don't have any accounts with this company. They have called my phone number over 17 times in a 24 hour period, looking for a Don **. I have told them repeatedly that I am not Don ** nor does anyone by that name live here. They still keep calling. I have asked for a supervisor to no avail. I want this useless company to stop calling my number and want to know what I can do about it. There should be a class action lawsuit to put this company out of business!

First capital one lied that they had called me on Sept 21. My phone is never off and even when it is busy, they never left a voicemail. First they increase my interest rate (with no notification) about 7-8 months ago from 8.9% to 15%. Then, when I cleared off the balance and requested an interest rate reduction, they declined it. So I told them I would not use their card any more. They apologized and then this morning when I looked online to pay my bills, they had reduced my credit limit from $17000 to $500. So when they don't want a customer they have many ways to kick you out. Not to mention that their customer service is so poor, even Spirit Air looks like a godsend compared to them (and their IT systems are absolute crap).

Capital One kept charging us late fees the first time we sent our bill, like 10 days ahead of time. They said it was late. Our account went over by like three dollars, so they sock us with a 70 dollar or more late fee. Once you pay late, no matter when you send your payment, it is late from then on. Our account balance was like $468. We would be charged like 500 dollars in late fees over the next several months. We later tried to go through Nationwide Debt Services after they charged us 500 dollars in late fees. We added this company to our account. They would not work with them.
So now, we are being sued by Capital One for 1200 dollars, demanding 26.50 percent interest on our account. I don't think they will get this because we complained to the court about that. It is being handled by a law group out of Merrillville, Indiana. So in other words, the 468 dollars, which is more like $420 because we paid like a $39.99 yearly fee before all this happened, will cost us 1200 dollars, around 500 dollars in late fees. This never should have happened because we were not originally late. Plus, they are asking the court for 26.5 percent interest if they would get my guess with attorney fees, which this lawyer won't even put down. They say $125.00 plus cost with relief. And this lawyer is ripping us off. If we are allowed to write this lawyer’s name down, I gladly will. So, if Capital One gets their way, 420 dollars will cost us I guess close to 2700 to 3000 dollars in lawyers and yearly interest and late fees, if the lawyer gets their 26.5 percent.

I like so many others have a complaint about Capital One Credit cards. I have 3 accounts with them. They do not have a high limit. But I did have credit protection on all of them. I have had these cards for over 15 years. I lost my job in January of 2008. I was receiving unemployment and was able to make my payments on time.
My unemployment ran out and I was still not working so I called to enforce my credit protection. I was told that because I didn't enforce it within 6 months of being unemployed I could not enforce it now. Well they told me I could get my interest lowered if I followed a program of 14% interest for 1 year. This makes no sense to me since I don’t have the money to pay them, and I was not calling to get my interest lowered. It makes no sense how they can get away with the stuff they try to pull over consumers eyes.

Bottom line: someone in area code (478) used my name to open an account. My SSN was not on the account. Apparently, Capital One couldn't contact them and so they slapped my address on the account (not in 478 area code) and sent the bill to me!
They have been sending me credit card offers for years. What if I had been stupid enough to have just paid the bill? Capital One's position was: no harm done; your SSN wasn't on the account! And then they wouldn't talk to me anymore about it because "it wasn't my concern". Looks to me like they got scammed and wanted to get their money from any warm body with my name. Hopefully, there are no other consequences since Capital One didn't have my SSN on record anywhere.

I was assigned for a service with Ms. Kare at the front desk, others customers came late and were served first! I made a complaint with her, who sent me to Mr George ** who treat me so bad and told me to leave his table and sit at the lobby again. He made me leave in his table my checks book and cash for deposit! After a while, he came and dropped the money and books at the front desk table.
I felt embarrassed, stupid and stressed in front of all the other customers. After I waited 10 minutes, I went to Mr Correa's (another manager) desk who served my questions. The bank has to fire Mr ** and Ms Kare.

I have had Capital One for several years now. Everything has been paid on time for 2+ years now. Things were smooth. Then, I got this letter in the mail about an annual fee $60 annually ($5 a month). I never had a card with and annual fee. Usually, I just throw those offers away. Now, I'm being forced to pay this fee or close the account. Capital One could care less. The supervisor told me he understands. Then a few sentences later asked did I want to opt out.
I feel cheated and like they're going to get their money one way or another and that the people with less money are the ones making them rich. The workers were more helpful and compassionate than the supervisor. To top it off, my account limit is super low anyhow and then to charge me $60 a year. This company and so many others make millions and billions off of people with late, overdraft, interest rates and annual fees. This is greed to me and I don't think Jesus would be charging people like this. Making so much money off of people that don't have much.

On June 30, 2006, I paid the "new balance" of $1849.08 in full before the due date and requested the account be closed. On July 14, I received an invoice for $1.24 representing unpaid interest charges. On August 14, 2006, I received another invoice for $26.11 representing the $1.24, two $4.00 monthly membership dues and additional unpaid interest charges. Although I closed the account, in an effort to clear this up, I sent them an additional $26.11 and $1.24. Guess what happened next? I got a bill every month for $4.00 membership, $29.00 in late fee and after 8 months, the balance escalated to $244.12 before they reported it as a charge off on my credit report in March of 2008 and after 50 phone calls trying to reason with these people.
Now comes the good part. I just got a bill from Capital One on August 16, 2010 for $545.92. They started charging me interest at the rate of 18.10% on the previous balance of $527.19. On the phone with Capital One, again they indicated that with the new credit laws, they have a right to charge me interest on a charged off account and that is exactly what they are doing. They also confirmed the principal balance owing on this account is $26.11, which was paid. In my humble opinion, Capital One and their practices are out of control and illegal!

Capital One is a horrible company. First off, I'll be the first to admit that I did not pay the limit on my card off. But keep in mind, my limit was only $500. Somehow, I owe Capital One over $1400. I called them about a year ago to settle my account. I had 2 other credit card companies that I needed to pay off as well, all of them had no problem settling with me except for Capital One. Capital One told me that because I'm a high risk and they are in the process of taking legal actions against me, they will not go down on the amount. I told them I was not paying that amount and my limit was only $500. That's outrageous! The guy then explained to me that if I don't pay that amount, legal actions will continue. I said, “Okay, take me to court.” Because I felt I could fight it and it does sound fraudulent
Also, keep in mind that I don't remember the last statement that I received listing this amount and the reason for the charges. About 2 months ago, I got a letter in the mail saying that I had been sued and I didn't show up for a court case with Capital One. This really upset me because I never got served with anything saying that I was being sued by them. I called the court and they said an officer actually served someone and whoever that person was signed for it. It was not me and no one else I know. That should be illegal itself, I believe. So, I setup a new court date with the court. The court date was this week. I'm just starting a new job and I'm still in training.
A training that I am not supposed to miss. Although, I showed my employer the document that showed I had to be in court, I would be missing hours of work and that means I wouldn't be getting paid either. So, I called the collection agency, who is very rude and took me forever to get a hold of, and stated that I wouldn't be making the court appearance and setup payment arrangements. I did this because I did not want another court case to be missed and I just look like the guilty one although the first missed appearance was not my fault.
I'm very upset with Capital One because I just cannot see myself paying over $1400 that I do not have and I don't know the reasons for me having to pay this amount. It's not right and they should be shut down because all they are doing is scamming people out of their money. Do not go to Capital One for anything!

I called today to an extension on my payment due to being in the hospital and was told they could not provide an extension when in my contract states that I am eligible for an extension once a year if needed. This is fraudulent conduct on behalf of Capital One Auto Finance. I then asked for the corporate phone number and was rejected that information. I have lost all faith in this company as being respectable or legitimate.

I dealt with Capital One for the first time and it was not a good thing because after I had a card, they started charging me late fees and crazy payment amounts. After a while, I had stopped paying my bill to the point where they started adding more late fees and charges to my account. I lost my job earlier this year, and we fell behind in payments, all credit card worked with us except for Capital One, they gave us a plan with amounts, saying they were due on the 15th of the month, but their statement was showing the due date of the 9th. They didn't get their money by the 9th and decided to turn over to collection, and now they are refusing to talk to us and they are still depositing the checks. The collection agency (or should I say Mafia) refuses to work with us with this matter and is very unprofessional in their practices.

Capital One has just taken over Chevy Chase Bank (CCB) in the WDC area officially this Monday Sept. 13, 2010. Being a former CCB customer, I have been experiencing nothing but problems this week. They include, missing accounts in my online profile, failure to close a matured CD, large balance requirements, service charges to two of my accounts without warning and accounts frozen for no apparent reason. In addition, I am also not able to use my ATM card which was supposed to be valid until I get the new Capital One card.
Since Tuesday, I have been on the phone with various bank personnel as well as visiting the local branch, all without success in resolving the issues. I've been told by the bank staff that I am not alone, that many CCB customers have been affected by similar problems. I have never seen a takeover that is this problematic and the worst is I don't know if there will be an end to it or if it's just the beginning of many more problems to come.

I received an offer from Capital One credit card for 0% interest for one year and no balance transfer transaction fees. Too good to be true, right? I had my husband look at it to make sure I was seeing the offer correctly. Yep. I called Capital One to confirm, no interest for one year and no transactions fees. I wrote the check. I got the funds. I got my first bill. No interest, no transaction fee. I got my second bill. $245 of interest. I called and I was told that I must have been mistaken because they have never offered 0%. It was really 14.9%. Yes, they had a record that I had called about the offer but their online notes only had "Balance Transfer" so it didn't prove what the rep had told me. I was also told that even if I could prove that the offer said 0%, they might split the interest with me but only if I paid it off in full. They have been nothing but trouble! Stay clear of Cap One!

Well, in October of 2007, I got hurt and subsequently lost my job because I was now disabled. I immediately called all my credit cards and explained to them what happened. All of them, except capital one, put my account on hold and offered me a settlement. I settled with all my cards except capital one because they said that since I did not buy their "insurance" they could do nothing until I was 6 months with no payment. Every month, they charged me a 45$ late fee and when their fees pushed my balance over the limit they started adding a fee for that too. I was paying between $70-100 in fees every month for nothing.
This continued until February 2009 when they charged my account off. Now my balance was twice as high as any charges I made on it. Then after selling my account to a recovery company in 2009 I get a bill from them in September 2010. They now claimed that even though they surrendered my debt they were going to charge me back interest from the time they charged off my account.
How is this even legal? When I called them, they told me that I was no longer doing business with Capital One, so they could do nothing for me but they are some how still able to charge me 25.9% interest rate every single month. When I explained to them that I am still disabled and I have been working with the recovery agency since 2009. I was informed that since I was still eating and probably paying some kind of rent that these interest fees make it fair for them that they still get there "piece out of my income whether I like it or not" news flash for them, I don't even have an income.

A little over a year ago, I reviewed my 3 credit reports as I do annually. There was a collection on my credit file for "Capital One". I sent Capital One a dispute letter sent certified mail from the Postal Service. They received it verified with a signature delivery. I never received a reply/response to my letter. As well, I disputed it with Equifax several times. Each time, I disputed with Equifax, in a matter of days it was reported back to me, they have verified the information is correct and belongs to me. I sent Capital One a 2nd dispute, sent certified mail along with a copy of my credit report.
This time Capital One replied back to me, they could not find an account matching the information I provided. I sent Equifax a copy of the letter and they still responded back that it is being reported "correctly". At this point, it's about 6 months later. I send Capital One a response informing them if they cannot locate an account in my name, by law they must delete it from my various credit files. A couple "months" past and they sent me yet another letter telling me they found an account with my social security number and the account belongs to me. I responded back to them according to the laws from ftc.gov website, during a dispute of a collection, they must provide proof , documentation the account belongs to the consumer.
I sent them another dispute and request for validation of the account. ( keep in mind the laws state that when you dispute a collection or inaccuracy on your credit file, the company reporting the error has 30 days to validate the debt) we are now talking about 7 months! About 2 months ago, I received a reply back from Capital One telling me they have found the account does belong to me and if I wanted anymore information, I should call there customer service number.
This is not what I requested, they are obligated to send me the verification in the mail in writing. They have violated the FDCPA and FCRA several times.over a month ago, I filed a complaint with the North Carolina State Attorney Generals Office. They responded to my complaint stating they have forwarded Capital One a copy of my complaint and in the copy. The attorney general's office sent me, it stated to Capital One, they have 15 days from date of receipt to respond to the complaint. It has now been a month and half and still no resolution or response. Thus, a few days ago I wrote the attorney generals office again letting them know that not only is Capital One violating the ftc laws in regards to FDCPA & FCRA, they are now totally disregarding the complaint sent by the NC State Attorney Generals Office.
Capital One is such a huge lending industry, they now think they are above the laws and owe the consumer nothing as far as proving an account belongs to them. It should be a slap in the fact to the North Carolina Attorney Generals Office that Capital One, basically stuck there nose up at them and flipped them off so to speak. Beware of Capital One people, I have since read 100s of similar stories with capital one. They will ** credit up, and if it is in fact an error and an account does not belong to you, good luck proving it to Capital One! It will literally take an act of congress to stop Capital One.

This company Capital One Bank extended a credit of $200 dollars. Before I could even use it my wallet was stolen. I called them and ask them to close the account. Instead they let someone charge a little over $200 dollars and in the mean time they sent another card with a limit of $200 dollars. I never used the card and I told them I didn't want it, didn't activate it and asked them to close it.
Now both of these cards are on my credit report for over $800 dollars. I recently received a letter from attorney wanting to settle for 60 %. I bet since the original debt was for $200 dollars and I never charged it . So they would be making double their money back. Crazy, I don't see how anyone takes this company serious. I tried to dispute this on my credit no luck.

In July, I made an online payment to Capitol One for my monthly payment. They did not post the payment until the day after it was due and slammed me with a late fee that they refuse to waive. They have refused to remove the late fee despite my providing them with proof that I made the payment on time. I was a day late in January with a monthly payment - literally one day - and now they have advised me that they are increasing my interest rates.

I've had a card with them since I was 19 (2002) and never had a late payment, never went over my balance (usually kept it at 30% or less). My rate was 10% for as long as I can remember then in the summer of 2009 after buying my house, I got 'the letter' saying it would increase. It's at 21%! I didn't do anything wrong! My credit is in the 700s so why am I being punished? I called and 'Bill' in India wouldn't/couldn't help! I try not to use this card unless I need gas. I am afraid it will somehow hurt my credit using it.

Capital One received my dispute regarding an unauthorized charge. They 'investigated' but failed to let me know that they re-charged my account with the disputed charge then hit me with late charges and finance charges. Then, ignored my faxed letter to them with a letter indicating "case closed" but they still charge late charges and finance charges after I confirmed with original company that the charge was an automatic billing, not authorized by me. Cap One refuses to close this account which was requested by me about one year before the unauthorized charge was posted to the account.

I own a small business in LA. It's a seasonal business, a golf range. I had used Capital One for my bank for 2 years. I started a merchant services contract with them for a credit card processing machine. It cost me $400.00 supposedly, a deposit for equipment. The equipment they sent was a refurbished Veriphone unit that worked for 3 months then quit. I called them and asked “What’s up!” Can they fix it? No they cannot.
So, I sent it back and was charged $300.00 for another one. Why should I have to pay for faulty equipment or honor the contract with them if they can't provide working equipment?! That one lasted about the same amount of time. I called and wrote them a letter canceling my merchant services contract. I sent their equipment back. Now it’s 7 months later. Every month now they charge a $20.00 merchant services fee, even though I had canceled. Of course, it put the account into overdraft. They were supposed to put $400 back into account the supposed deposit. It never happened. Now they charged off $325.00 in fees and merchant service fees and I’m fighting with them. I'm going to the attorney general here.

I have repeatedly tried to set up automatic payments with capital one. Repeatedly when they call to collect money, they say they can deduct the money from my bank account they have on file. However I have repeatedly asked why they do not offer automatic payments on their website. They cannot give me an answer. It seems they intentionally make it difficult to pay your bill so you are forced to get late fees. This should be illegal. If they can push a button to deduct money for my payment when they call me, they should be able to push a button and set up my automatic payment for me. Making it difficult to pay your bill is dishonest and should be stopped!

In January of 2007, I paid my last $300 owed on my card via check. A few months later, they called to say I owed almost $500 since I hadn't sent in a payment since January. I explained that I had made the final payment and hadn't received statements since. I ended up having to have my bank fax proof of the check they had cashed. They mailed the fax back to me saying they must have received it by mistake. I was then sent to a collection agency.
I explained the whole thing to the collection agency and even dealt with a supervisor. It got bumped around to various collection agencies. Finally, after talking to Capital One various times, it was found that the money had been credited to a closed account! Yet they left the money in that closed account and didn't bother sending me a refund or anything. So the next time a collection agency called, I told them that I had proof of the check being received and gave them the account number where the money was mistakenly deposited. They refused to do anything and said it was on Capital One.
Capital One tried to take me to court over a year ago and ended up dropping charges after I put in a counterclaim showing I had proof of where my money was and them taking it. Now I still get collection notices and calls for thousands of dollars due to interest and late fees. My credit is looking seriously bad because of this and it even hampered my ability to move my family into a house. I can't afford to sue Capital One myself and I'm sure they are just waiting for me to pay this whole thing off. I should owe them absolutely nothing, but instead they have been ruining my credit for almost 4 years and there is nothing I can afford to do about it. They are incredibly horrible people and scam artists! This is a serious blemish on my credit report. I tried to buy a house a year back and was told I couldn't get financed because of the Capital One account on my credit report. The most recent collection agency calls my in-laws and refuses to even acknowledge the new phone number and change of address sent to them.

I have had a Capital One account for over 12 years. I lost my job in 2008, and have been struggling to pay off my balance. My rate was always 9.9%. In Feb. of 2009. They raised it to 15.9%. I immediately called and explained my situation and asked what could be done as far as lowering my rate and or monthly payments. They were absolutely unwilling to help in any way. I explained that I was struggling to make the payments at 9.9% and would not be able to make higher payments at 15.9%. I have called at least 7 or 8 times over the past year, all to no avail. I have even asked to close the account and settle. They said I will be sent to collections. I will never use their credit card again. I was never late on a payment once in 12 years!

I paid off the balance on this account on or about October 2009. I assumed that was end of my account with Capital One. I was never issued a card, however I may have received them periodically. The mistake I made I let another individual use my credit. I was not concerned as he kept with the payment. He suddenly declared bankruptcy so I felt obliged to make the payments. I corresponded with Capital One on this matter but did not receive a reply. I am now getting statements on this account. I called them and was informed that the account was still active and no balance. Capitol One has a right to charge me a fee and it seems they can change a fee on a fee and keep adding on account due. I am surprised that Capital One as large it is supposed to be would stoop to this kind of practice. I am afraid I may in for legal action before I pay the current charge of $65.54 as a result of fees on an account the was paid in full in or about October 2009.

I had made payment arrangements with Capital One that I have been paying on for 10 months now, and unfortunately, had to leave my job because of physical problems. I contacted Capital One and made them aware of the situation, and asked if they would give me a few months to find a new job that wasn't so physical. They said that they would notate my account but the judgment was still valid. I said okay because I have other judgments and they were all willing to work with me so I thought nothing of it.
The following month I was checking my bank account and realized there was no balance I immediately contacted my bank to find Capital One had put a garnishment on my account. They had told me that balance of $803.00 was due now. No minimum payments would work. I asked why didn't you tell me that at the time I called. They said that they did not have to. My husband is a roofer and work has become very very limited for him. In the last several months, sometimes, he could go weeks without work and that is our only income we have, and they do this to us.
I had 27.00 dollars and they took it. I have three children and have no income. And to top that, my own bank charged me a $100.00 fee for a garnishment on my account. They will not take the hold off until paid in full which of course, I can't come up with.

On 1/4/10, I called Capital One to close my account. You get their service dept in the Philippines. After getting transferred many times, finally got someone whom I could understand. The Rep was very nice and told me the account was closed at 10.99% and I would see that it was closed when I received the next bill.
On 1/27/10, I got the Feb bill and it wasn't closed. I called again and had to go thru the same routine. When I told the rep of what they said on 1/4/10, she laughed and said you obviously didn't get it in writing did you. I got a supervisor and told him the problem and was laughed at again, but he promised to close the account immediately.
On Feb 26, 2010 I got the bill and not only they didn't close my account, they raised it from 9.9% to 17.9%. In early April 2010, I got calls from collections in Salt Lake City, 6 phone calls within 25 minutes. I complained to the FTC and the BBB and received an email a few days later stating they only called me once. I have the caller ID times to prove I am right.
Early May 2010, I sent them a cease and desist letter and haven't been bothered since. I am out of work and tried to cut a deal with them but all they want me to do is send some money now and then they will put it in writing. I don't think so Capital One. My bill has jumped over $300 in late fees and many other add on bills. Once I get a job I will get a lawyer

I signed up for Capitol One protection Plan like i did for all my credit cards for capital one, Citi, Bank of America, Chase In 2007. When I lost my job as a loan officer at the beginning of the current real estate crisis in 2008. I called the protection plan for all them filled of applications and did the required administration procedures including going to career center to get the signed for proof of enrollment of job search. They all start paying the less minimum monthly payment “less than what I was paying" except Citing Bank who was just holding on your account and for 2 years in condition of returning the monthly signed form every month. I did that until the carrier center decided not to sign those paper on site no more.
Carrier center wants us to send all form to one single office to sign them up and they will forward them to the appropriate lender' plan. Those paper work start going out late. Bank of America and chase gave some other alternatives to keep the coverage, but capitol one and Citi just went ahead and terminated the program and got me defaulted on the accounts. Now I have derogatory reports with hick balances. Rental apartment, and as a finance career I will probably not get any job whit it. Everything is tight to credit now and days.

We settled a debt with this company through Franklin County Courts for a 2003 Ford F150. I have called asking for a title to my truck as they are required by the courts to release it to me. This was not the first call. On previous calls, they stated that the lien was released and the title was sent out. I have yet to receive the title so I called back once again today. Zee basically told me they have done all they planned to do and I am out of luck. He would not allow me to talk to a manager or give me direct call back number to his office. I am very frustrated. I offered to give them information so they could send a release to the local DMV he refused to do. I am looking for any and all help I can get as I really do not want to spend money on an attorney to get this resolved. Please help.

I was late on my Capital One card payment and received a phone call in March 2009 from a woman by the name of Phyllis representing Capital One and their claims department. She asked me if I wanted to enroll in a program that would get me back down to my original balance ($3,500) so I would be charged additional fees. We came to an agreement that I would pay $293.34 for months April, May and June. This would then bring it from the $4,200+ down to $3,500 (my credit limit). I was told that everything was included, late fees, overdraft fees, finance charges etc.
But the finance charges were not included. I was really upset because at the end of the 3 months, my balance still was above $3,500 like almost $3,800. That means my next payment had to be well over $300 just to get it to the $3,500 and thus the program I enrolled in was a fraud. I tried to call Phyllis back at least 3 times and no one would let me speak to her. I tried calling different numbers at Capital One and no one was willing to help me. It was a tough luck and I had been duped.
My payment for the month of July should have been a little over $100.00. Mind that fact that I really sacrificed a lot to pay this bill down. I worked as an AmeriCorps making on $627.51 per paycheck. My rent was $812 and I was paying Capital One $293.34. This is just not right that I was duped like this. I want to know why would Capital One enroll me into a program to get back on track and update to get me back to my original balance and this is not what happened.
I fulfilled my part back paying the $293.34 for three months and was going to start paying the on the original balance starting in July, but how could if I had to make another payment of over $300? I had already made plans to visit home so there was no way I was going to have the money to pay $300+ and then I would end up late, over the limit and additional fees. It is really terrible that I was duped into this.
