I want to know how you use your debit card with funds available as the day goes by. But at the end of the day, the bank drafts the greater amount first which has made me multiple overdraft fees instead of having one. This has happened a lot. I asked why they wouldn’t keep debits in the order in which they were made. They said they take the highest to lowest first. I think this is overdraft fraud.

I received my credit card today and activated in the morning, tried to use it the same day and it was declined. When I called Capital One, they informed me that there was a supposed fraud alert. They instructed me to send in copies of my driver’s license, bank statement, utility bill, and my w-2 or 1099.
I thought this was a bit weird. Then I read another post here and another consumer complained about the same thing. By the evening I called and cancelled the It appears what they are doing is collecting the initial fees that are on the first billing cycle. Then when they review your information, they decline access to the card.
This has scam written all over it. This is just one way they are trying to make money off of those with less than good credit. Please, if you have experienced the same, report it. If it wasn't for someone here taking the time to report this same experience, I would have been victim to the same.

I found a 0% for one year balance transfer offer from Capital One online in December 2009. I applied online and was immediately approved. I have been making on time minimum or above minimum payments. I do not use the card and since I make payments online, I hadn't even noticed that I wasn't getting a statement (I have several other bank accounts/cards).
They've been charging me interest the whole time, which is odd because I never noticed it before. I immediately sent an email through their website trying to find out why I was getting charged interest when I'm supposed to have 0% for one year. Here is the reply I received:

I am writing the Consumer Affairs Office with both a complaint and concern. Currently, there is information that leads me to believe that two business entities that I have no knowledge or affiliation are utilizing my personal information as a business owner or administrator. The two entities in question are: California Community Research Education and Dragonfly Records.
The way in which I was alerted to my name being associated with these entities was via two unsolicited mailings for business credit lines being offered by Capital One. The dates of the unsolicited mailings were 8/28/10 and 9/11/10. Upon receipt, I went to multiple Secretaries of the State websites to look up the business entities including CA, NY, AZ, MA, FL, CT, DE, NH, IL and D.C. I was unable to locate the businesses either through the entity name or via my name. My obvious concern is that an individual(s) is utilizing my personal information to create new businesses and possible gain access to credit cards, lines of credit, etc. As a result, I am writing you in hopes of obtaining your assistance in whatever capacity possible so that I may resolve this issue and remove my name and information in association with these entities.
In addition to contacting your office, I have also written the CA Attorney General's office as well as Capital One to notify them of my lack of knowledge and involvement with the named entities with the hope that no line of credit or credit card has been issued to others claiming affiliation with the companies.I would like to reiterate that I have no knowledge of, association with, never worked for, volunteered for, and provided either solicited or unsolicited information or research for either California Community Research Education or Dragonfly Records.
I am unaware if credit cards or lines of credit have been opened up for the business, which could be reflected on my personal credit score and make me liable for purchases, and money advancements I have no knowledge of and responsibility to. Your assistance in this most important matter is greatly appreciated.

A credit card debt collector has been calling me over 12 times a day on my cell. Then it lead to several times a day at my work. Not only that they managed somehow to find the number to my company cell phone (only used during work hours)—how can that be? When I asked them how did they get that number, they would not reply and kept harassing me to pay my bill. I can't take it anymore and I don't want them interfering with me during work. The cell phone contact for my work was the last straw. They would have had to call my corporate office to get that. I have turned them into the Federal Trade Commission, but was told that the FTC does not handle individual issues, that they would consider it if many others have called in and it appears to be a national issue they would represent.

I had Capital One credit in the past. I filed bankruptcy in ‘03. It’s been 7 years of cleaning up my credit. Then Capital One sends me a gimmick of applying for credit because I’m past the bankruptcy stage. Like a dummy, I take a chance since I’ve been doing so well. They deny me anyway causing an inquiry on my credit and my score to drop. They sent me four different offers, inquiring me to apply. This is a disgrace. I will be reporting this to the Better Business Bureau. I didn’t ask to apply and they kept sending me offers. The damage is done to my credit report. Do not sign with this company: they’re a joke.

I have had and maintained a Capital One credit card for about 8 years. One would think that CO would cater even a bit to one who paid their bill in full on the due date; however that is not the case. The last several months I have paid only amount that is stipulated as "due". However, I noticed a charge of $19+ on my June bill. I am usually careful about reading charges but somehow I missed this charge. I called CO customer service and was told it was a "finance charge". I asked how that could be possible when I pay what is due and he explained it to me but I still didn't understand and I repeated my concerns. He explained it again by first saying "well, credit card companies calculate it differently than you would".
We wrangled about it for about a half hour and I said to him that if this is not resolved, I will cancel my card immediately! Eventually he removed the charge. Following our conversation, I then went back and found that I had been charged this same $19+ on the previous two months. I did call back and it was removed after again a lot of "talk."
This past month I noted a $6.+ charge for "interest". Again I called CO and spoke with 3 different service people. It was explained that the charge was because my son who has a companion card had taken "cash out". I told him, there are already fees attached to that transaction that amounted to about $25 dollars and that is quite enough. The bill again was paid "amount due at this time," not minimum payment. He explained to me that the credit card company in the case of "cash out" charges interest from the day it is taken to whatever day your bill is paid in full. Even though you pay total amount due at this time, that doesn't matter. He tried to help me but his software would not allow him to. After about an hour on the telephone another "senior" clerk got permission to erase that charge and it is noted that this was done on this month's bill.
Company does not want people to pay on time. Those who do not pay eventually pay terrible charges or co-writes it off including the crazy charges. For company. it is a win-win situation.

Since January of 2009, I lost 54% of my income. I was working two full-time jobs, but was laid off of one of those jobs in January of 2009, and had the hours at my second job reduced to 28 hours per week in December of 2009. That job only pays $9.50 per hour, so I don't make that much. I fell behind with almost all of my creditors and began contacting those creditors, attempting to settle the accounts at reduced rates. Capital One refused two such requests (the second request offered a larger settlement than my first request). They turned my account over to a law firm.
My credit limit is $2,500, and I was close to that amount in late 2009, having been 11 months without my second job and very short of money. However, as I fell behind, continuing interest, late fees, and over limit charges have added over $600 more in costs. My balance is currently listed at $3,168.78. As I had recently begun receiving unemployment benefits and was in the trial period of a mortgage loan modification, I responded to the law firm, with a copy of the letter to Capital One, informing them that my financial situation had improved. I offered to pay $150 per month to bring my account current within 5 months, resume normal payments after that time, and stated that I would make additional payments whenever I could to pay this account off as quickly as possible. That $150 is about three times what my minimum monthly payment previously was. I asked the law firm to discuss this offer with Capital One and advise whether or not this would be acceptable.
Also in that letter, I informed them that I had contacted an attorney who advised me that 93% of my income (a state pension and the unemployment benefits) was exempt from any collection efforts. That meant that a lawsuit and subsequent wage garnishment would yield only about $20 a month to Capital One. I was offering $150 a month. I informed them that I had no equity in my home and the home was homesteaded, I had no equity in my vehicle (I owe approx. $17,000 on that), I have no cash reserves, and I own no other property. I don't have anything that they can take, other than the $20 a month in a wage garnishment.
I received no response from the law firm, but did receive a letter from Capital One, dated July 1, 2010, that my account was now being handled by TSYS and that future settlement attempts needed to be handled by them. Obviously, they were not willing to accept my $150 a month, or make a count offer and see if I could afford to pay a little more. It appeared to me, from that letter, that they had charged off my account and sold it to a collection agency. I pulled my credit reports and this account is listed by all three credit bureaus (Experian, Trans Union & Equifax) as charged off and in collection. I assumed that was also the reason that I had received no response from the law firm, as it appeared that they were no longer in the picture.
Although I was told by Capital One, in their letter, that I should contact TSYS, I chose to wait for them to contact me. I was hoping that it would take them a few months to get to my account, and we would be closer to November of 2010. Several creditors were willing to work with me and those accounts will either be paid off or brought current in November. At that time, I will have more money available to help with settlement negotiations or a payment plan.

In spite of the fact I pay my monthly bill on time every month, I have been receiving collections calls from Capital One for almost a year now. The calls are always the same. The representatives tell me that my account is almost $300 dollars over the limit. I tell the representative that the overage is from over the limit fees charged by Capital One. The representative is asked to look into the matter, and not being able to look back in the system past six months, the representative informs me that I charged my card over the limit; an impossibility since I destroyed the card long ago.
Representatives are consistently unable to communicate further than the collection script from which they are working. The majority of the calls come from Mumbai, India. The breakdown in communication and inability to relay my plaints are always frustrating, putting both the caller and myself on the defensive, and never resulting in a satisfactory solution. The last representative I spoke with, after stating I would send a letter, could not even give me my full account number to reference for this letter. All she said was, "Be sure to include your name." Knowing I was sending a letter, she still did not offer help or a solution.
The aforementioned grievances are indicative of the lack of ethics, and the business as usual attitude that permeates Capital One's business practices. During this economic recession, many have fallen on hard times. It is impossible to make ends meet and keep bills paid. Those of us who hold private credit card debt feel the pinch just like everyone else. We have received no benefit from federal economic recovery and bailout stimuli. Capital One, however, has benefited handsomely from the federal stimulus package. I would have thought that a company receiving federal funds in order to keep its doors open, would conduct their daily business with a bit more tact, leniency and understanding. I would have imagined that Capital One would have been as compliant with their clients who are financially stressed as my federal government has been with them. However, Capital One, having benefited from the federal stimulus, continues to conduct business as usual; unregulated, bullish, unethical and harassing in nature.
Collection calls, harassing in nature, absurd in their frequency, lacking in ethical professionalism and disregarding the economic hardships of others are exemplary in their hubris. No offer for solution is ever proffered. No assistance is offered to restructure the account. Harassing calls demanding payment of amounts due above the credit I have charged (due to excessive fees) are immediate and incessant.
From the representative's unhelpful responses and inability to obtain account information beyond 6 months prior, it is obvious that this behavior and practice will continue unabated. Are you aware of the liability issues involved here?
You are aware of the invasion of privacy, continual harassment, and the unethical and usurious fees created here. My debt to Capital One does not allow the crime of invasion of privacy, "seizure of my effects", and usurious fees and capital gains. I am sure that Capital One does not wish for this to become a matter in the courts. What do you plan to do to reconcile or make restitution for this grievance? I do not intend to let this issue go unanswered. High, usurious interest rates, inexplicable and unimaginably opportunistic fees collected, and practically non-existent customer service, present just tip the iceberg of complaints and complications in my dealings with Capital One. The real issue is that I am expected to pay Capital One monies that I did not charge to my account. I am requesting that these fees be removed so I can continue to pay the balance due that I charged, and that I receive a statement of all fees and charges associated with this account since it was opened, so I can further illustrate my issue when petitioning the government or speaking with counsel.
I will continue to petition my government, as is protected by the 1st amendment, and research the legality of these usurious over the limit fees, especially as it pertains to the consumer protection agency and legislation therein. I also am researching whether the 4th amendment is being violated by Capital One as they try to "seize" my "effects" without "due process". I did not charge this amount to my card and feel my assets are being requested and taken wrongly.
Capital One has succeeded through the forced generosity of the American taxpayer. It is criminal that after such a bailout, it is business as usually at Capital One. I expect your response.

I had a Credit Card with a 9.9% interest rate. When I opened a bill about a year ago, I noticed that my payment had increased. I looked at the interest rate and it was $17.99 interest. I called and spoke to a Capital One rep and asked why my Interest rate had increased since I had always paid my bills on time. I was told because Capital One had made so many bad loans.
They had to make up the lost money by charging higher interest rates. This was on a existing balance so I asked to speak to the supervisor and was told the same thing. She then said, "Hold on let me see if I can do anything for you to lower the rate." She came back on right away and said, "Sorry, there is nothing i can do." I advise you to get another card with a lower rate and transfer your balance to that one and keep Capital one for emergencies.

I was a brand new customer with Capital One credit card company, being approved on August 4, 2010 and receiving my card on August 11, 2010. I activated my card and then went to the bank to withdraw $20 on a cash advance just to see if the card was activated. The bank denied the transaction. When I called the customer service line to see why, I was told that the "security feature" had been activated and that I would have to send in a lot of unnecessary personal information. I blatantly refused and asked them to close my account immediately!
I am glad I did because I see now that it would not have been worth the hassle to be a "platinum" customer with a $300 line of credit. I was hoping to build my credit as a recovering over-shopping, ill-informed teenaged consumer. Now I am extremely disappointed I even allowed this company access to my credit report. As it is bad for your score to have multiple credit checks, I have to wait another 3 to 6 months to apply for another credit card. This time, I will make sure it is a secured account with a reputable company. This company is a straight up scam and no one should use this company to build credit ever! What's in your wallet? Capital One's grimy hands!

I did a balance transfer and did not receive a statement for 2 months in which I received a call that I was past due on my credit card. At that time I made payment over the phone. $45. I told the woman I did not receive a statement and that I need to have statements mailed to me. A couple months go by and the same thing happened. I did not receive a statement. Received a call on the phone to make payment. At this time, I was furious and told the rep that I needed paper statements to pay from. They sent me May, June and July which came on the same day at the end of July. I asked repeatedly for resolution in which Hugh informed me that there is no resolution. I asked for his supervisor and he told me they don't take phone calls.

They have bad credit card policies. I feel that they are not following ethical and legal credit card policies. They have raised my interest rate on the non-promotional balance. While checking my statement on this in-active card, I discovered that my principal balance was actually increasing on this portion of my balance. They are effectively charging interest on interest. At this rate, I will never be able to pay off this card.

On the month of August, I had been using my card to keep track of restaurant bills due to a fire in my home that left me and my family in a hotel for 2 weeks. I believe that made them take note of so much activity on my card because I hardly ever use my card. I am a perfect customer to them, balance is low and never late on my payments. After receiving my statement on Thursday August 5th and seeing my available balance was 3,705.68 (credit limit of 6,900 and previous balance of 1,604.72), we had gone to the store on Saturday the 8th to purchase tiles for a portion of our basement that had been destroyed by the fire. We have to pay first and insurance will reimburse us later.
The credit card was denied for a purchase of 768.25. Embarrassed, I asked the girl to run it again as there must be some kind of mistake. She gave me that look like whatever, ran it thru and it was denied again and she laughed. Getting out of the store I called the card services, so embarrassed and mad at the same time. They said my credit limit had been reduced from reports from the credit bureau. I asked them if my perfect history was taken into consideration in their decision and they said no. I have not received a notice of this change. Today is the 11th and after speaking with them they said they didn't have a phone #, which is a lie because they contacted me by phone when I was in Mexico in march 2010.

I wound up with past due fees, over the limit fees, finance charges, a "Corresponding APR"of 22.40%, a periodic rate of .03167%P.
Along with my regular finance charges, it became too much. At request I can provide account information details. Please contact. Thank you. Added emotional distress. Ruined credit standings. Prevented me from the ability of obtaining long term employment, housing (Apartment Rental etc).

I must relay an entire series of events which I consider to be disturbing. I feel appropriate actions must be taken to rectify this situation. I applied for a secured credit card on July 22nd and was approved. I electronically transferred $2000 from my savings account to your bank as a deposit. I then called to make sure the funds were received. I was informed they were.
About a week later I received a telephone call (and a mail afterwards I believe) from the fraud department informing me that I needed to call Capital. When I called I was told I needed to submit a savings account statement. I ended up speaking with a supervisor because the customer service agent didn't explain this properly. The statement needed to include my name, address, and account number. This was to prevent fraud which seems to be a huge problem for you with these secured cards (I was told this). Apparently, my bank doesn't freely give out this information so I agreed to send the statement. I was told to fax the document.
I asked the supervisor what the fax number was and waited at least 4 minutes (glanced at clock) for her to find the fax number. I told her while she was looking to give me the physical address. No answer. Keep in mind, you contacted me. I called and the supervisor can't even give me a number for what you required that I send for at least 4 minutes. I called my banker and requested this be sent immediately. He told me it would be done within the hour. Another week passed. Still no card. I called Capital to find out the status. I was told the fax wasn't there and maybe it was delayed in the Caribbean (I didn't know you sent jobs there) and you should have it soon. I finally got my card in the mail but was unable to activate the card. I called again and was told by a CSR that there was no fax. I had confirmed it was sent by my bank. So I spoke to a supervisor (Alfred?) who told me the fax had arrived. He verified this and said everything would be fine this week and he would make sure of it.
So yesterday, I received another letter but I was going to call anyway as 14 business days had passed. I was told by a supervisor that no fax had been received. I asked to speak to an account manager because I was concerned since I was assured it was in your possession. I was frustrated and decided to just do business elsewhere and explained my problem to the account manager. Rather than trying to keep my business, he (David) said he would connect me with someone who would help me cancel. I was on hold for 25 minutes. By the way, these delays are constant and I was hung up on three separate times. I started leaving my phone number early on in case this happened.
I finally hung up because I couldn't wait any longer at that moment. I called later and was told the card had been canceled by a CSR. I was surprised and spoke with another supervisor and asked if I would receive some sort of e-mail explaining the terms of the refund (when , where, etc). She said no but I would get a letter sometime later. Her name was Ashley. I asked to speak with an account manager to confirm this and request something in writing to verify the refund. After all, I got one when I sent the money so it seemed practical there would be some details available. The next account manager was very nice. Her name was Koren. She told me that you don't lose paper at Capital (yea sure) and I just needed to send the fax again. Or I could go ahead and cancel. This process seems to be confusing to everyone but me. I sent $2,000 of my money to use and I want it back since you lost the fax and no end is in sight. So, she told me that this was a new product (a secured card) that was being introduced again and there was much fraud and she didn't know the details of canceling.
She then told me she needed to check with the products division. She had me connected to a man named Calvin. I thought he was a supervisor. He explained that it would be two billing periods (2) before I would get my money back. So basically I am not able to use this money for a security deposit elsewhere or anything for that matter. So then I decided after finding out it would be two billing periods, that I would just send another fax. He replied that it was "too late" and that the refund was already in progress. I'm not sure this is true because we're talking minutes here and it takes 2 billing periods to get the money.
The purpose of this waiting period I thought was to make sure no other charges appear on the card. I Never had an active account at all because I couldn't activate my card so how could this apply to me at all? I told him I thought this was silly and asked to speak to a supervisor. I was disconnected (what a shock). I called Koren again and with my phone dying (was on the phone 4 1/2 hours) asked her if this was true. She said it was policy but she had the authority to open my account if in fact it was closed. She showed it open contrary to Calvin. So I chose that option for now. I'll send another fax and yes, you do lose paper, maybe faxing and investigating from the Caribbean to here.
But I must tell you, this is still problematic and you can expect the worst possible outcome. This is a horrible example of customer service. I'm sure you've heard the theory that if a person is satisfied with something, they may tell 3 people; but if not, they will tell 10 people. This will be the case and that's the good part as far as you are concerned. Thanks for your time. I don't want to do business with this bank but am forced to do so or wait two billing cycles to get my money back. I Never was an active customer. My card was never activated. They wouldn't allow it. I can't use the money as a security deposit elsewhere.

Three weeks ago, I purchased, or thought I did, a new car that was apparently financed through Capital One. I have been speaking to Jeff about this loan. I went to pick up my tags for my car to find out I have never been financed for my car. Simply, because Capital One did not approve me. What I do not understand is that, I spoke to Jeff twice this week and not once did he tell me this. Maybe it is not his job, but he did a crappy job of delivering messages, especially to wait 3 weeks to do so after moving to another state.
My car dealership has done an exceptional job of helping me get refinanced with another company and I will never have anything to do with Capital One. It would have been simple to not finance me weeks ago or just have told me when I actually spoke to him directly instead of making me wait 3 weeks. Why beat around the bush?

I always pay my credit card bill in full. A couple of months ago, I read the bill wrong and underpaid it by about $20. When the next bill came, it included the amount I underpaid along with an interest charge that exceeded the amount I had underpaid. When I inquired about the more than 100% interest, I was told that when you don't pay in full you are charged interest on the total amount of the bill.
I then asked them to close the account and I would pay off the remaining balance. This I did. Then I got another bill from them a month later, with a new charge from a linked account (eBay). Instead of rejecting the charge, which they should have done, they sent me the bill along with some more interest - which I can't figure out, since the charge was new and the bill wasn't late. They agreed verbally to take off the latest interest charge and let me pay the last bill and close the account. This I did.
But today I got a call from them that there was some recent, suspicious activity on the card and we have to go through an investigation to see about these fraudulent charges. They continue to leave the account open! Now they say the only way to correct the problem is to close the account and issue me a new number. I told them I don't want a new account, but they say that's the only way to fix this problem. They've got me speaking with people that have such heavy accents. I can barely understand what they're saying, and I don't have any guarantee this will be dealt with, other than someone's verbal assurance.
This is the worst company I've ever dealt with. They are the reason we need financial reform.

I called for a hardship because of my illness and they refused to help me. I had no means of getting up even a payment so my $300 card sky rocket to $880.69 and now they are suing me.

After years of using a credit card with no rewards, I did research on which cards provided the most benefit. On their own website, Capital One No Hassle Rewards proclaimed "$0 Annual Fee", for excellent customers, so I applied. When I received the card, I called to activate it, and found out that there would be a $39 annual fee. When questioned, Gabriel could not tell me why - either my credit score wasn't high enough to qualify for that card (it's over 900!), or they had sold "too many of that particular product". It's not the point of $39, it's the "bait and switch" tactic they use.
Now, if I close the account, it will affect my stellar rating. Gabriel said I could call on the month, when they did assess the annual fee. He said it could be between next month and next year, and call to have it reversed. That may or may not work, he said. It would have been better, never to have opened the card at all. I will be writing Richard F., CEO, and the Attorney General for Virginia regarding this matter. Consumers, beware - don't have Capital One in your wallet!

In October of 2004, I opened a Capital One credit card account. I was encouraged to purchase the payment protection plan and I did. I charged a total of $908 on the card prior to losing my job. I did not use the card, even once, after losing my job. Believing I would get another job quickly I continued to make the payments on my own until it was impossible to continue to do so. I contacted Capital One in order to engage the payment protection plan and they told me I had waited too long, from the date of my unemployment, to do so. I was no longer qualified to use the plan. They continued to charge me monthly for the payment protection but would not allow me to use it. As a result, I fell further and further behind and accrued interest and late charges. I contacted Capital One on six separate occasions to request that the charges be discontinued but they ignored my request and continued to charge me.
The payment protection fees, plus the late fees drove the account over the limit and now I was being charged over the limit fees as well. In addition, I was also charge an annual membership fee of $59.00 - this is for a card that I canceled. The APR rose to 29.24% which further compounded the problem. In June of 2007, I was contacted by a collection agency, James A West, and spoke with Mr Gary **, who informed me that the balance due was now $1560.75. After discussing the account with Mr **, he and I agreed that I would make 9 monthly payments of $100.00 each. And the account would be satisfied as paid in full. This seemed like a final way to get this monkey off my back. However, it did not turn out that way.
I made all nine payments, on time, marking the final check "paid in full". At this point, I paid a total of $2,150 to Capital One for an original dept of $908. On May 20, 2008, three months after the final payment was made, I received a letter from another collection agency, Eichenbaum & Stylianou, stating that I owed Capital One $1,156.74. Thinking this was a simple paperwork error; I contacted them and explained that the account was satisfied as paid in full to the collection agency of James A. West. After Eichenbaum & Stylianou I was contacted by yet another collection agency, The Northland Group, who were attempting to collect in the amount of $1,379.63. They offered a settlement in the amount of $872.78. I contacted them, at once, and again explained that the dept was satisfied.
To date I have been contacted by 5 different collection agencies all with different a balance due. I contacted the Office of the Comptroller of the Currency who forwarded the information to the Federal Reserve Consumer Help Center. They found that I had sufficient evidence that there was an error - I sent every one of my billing statements and the letters from collection agencies - but since the dept was charged off there was little they could due. It's important to note that while I have a letter from Capital One stating that the dept was charged off in April of 2007, my credit report shows it being charged off in May of 2009.
This has been a fiasco and the most dishonest, unethical business practice I have ever experienced. While Capital One has been insulated against any negative impact from their mistake I have not. This has destroyed my credit and made it impossible for me to get a reasonable interest rate, a car loan or a student loan for my daughter's college. We are still trying to recover from this. I was just turned down for a car loan, again, last month.
I have done everything I know of to get this corrected, all to no avail. I simply don't know what else to do. If I can do anything to prevent anyone else form experiencing the same thing at their hands I happy to do so. This experience has severely damaged my credit causing me and my family to suffer a great deal of stress. I cannot get a car loan; I cannot get a student loan for my daughter to attend college. I was turned down for a lower mortgage interest rate and auto insurance, all because of this one "bad dept" when in fact it was paid two and one half times over.
It seems like it will never end. They continue to "update" my credit report making it look as though this dept was just charged off when in fact it was charged off over 3 years ago. I feel like a complete idiot for taking the credit protection plan because it was useless and cost me a great deal more than it should have. I was diagnosed with high blood pressure and while I'm not blaming it on this incident, I can assure you it didn't help!

On July 7th, we received a letter from Capital One dated July 3rd advising that we call regarding suspected fraud charges. We called immediately, were given the suspect charges, we checked with our employee responsible for the charges who confirmed they were legitimate. We called Capital advised them of this and were told that our card had already been cancelled and we would receive a new card in 2 days. We did not receive the card in 2 days and when we called to complain were told they would send another card again to be received in 2 days. The card has still not been received.
Another letter from them dated July 15 obviously totally unfamiliar with what had already transpired started with "We have received notification of your lost/stolen credit card and a restriction has been placed on the account to prevent further authorization of charges.” Our bills are paid in full each month. This is a company that is not paying attention to a customer's serious problems and is causing serious harm to the customer.

We had a current balance of 17k on a Capital One credit card. I had been out of work for more then 6 months this year and living on a strict budget and barely making ends meet.
Capital One would not lower our interest or help us out in any way, therefore in an effort to be good citizens, my wife applied for a Discover card and transferred the Capital One balance on it since it had 0%interest. It turned out that Discover only made a payment to Capital One of $5400. We didn't recognize where the payment was coming from and it went under the department of payment investigation of Capital One. When we figured it out, we asked the Capital One to send the $5400 back to Discover and called Discover and told them we were only interested in a full transfer balance not a small payment. This happened on May 10th of 2010. Ever since then, my wife has been almost weekly if not daily with Capital One and Discover card as well. Our Capital One balance is today $17K and Discover card balance, $ 5709.
My wife and I had spoken to countless senior account managers and these are some of the contradicting things they told us: "the money had been sent and it will take between 48-72 hours to process" or "it takes between 2 weeks to 17 days" or "we sent the money but Discover keeps rejecting the funds". Discover absolutely denies that. We even had three way phone conversations with Capital One and Discover where Capital One promised to send the funds and I had just called again, and as of 5 minutes ago, Capital One is still holding $5400 on which we owe late fees and charges and are at the point to be turned in to a collection agency.

I've been told by an account manager that, "If you people just pay your bills you wouldn't have problems." That's just one of the many things, I have a big list of things said to me. My home was sold in an auction before that date written in a letter from the manager in a modification. Rescinded on the same day, but no one has explained much after that. I don’t know what’s going on. I called them and they told me that the modification would not work because they found I had $35,000 in the bank. That is not true. I tried to explain to the closer that that money wasn’t available, that it was a secured loan against that $35,000 and that none of it was available. Please, maybe you can get them to answer.
I’ve been in bad health since this happened. I can't sleep, I’m losing lots of weight due to stress caused by Capital One. I've been trying to work with them in every way. I now call every day. This Capital One credit card was my first with a $300 limit. My troubles with them started approximately 5 years later. My card had a 2005 expiration date on it. I called after not receiving the updated card and was told it was in the mail. I explained that we were moving out of state and wanted to make sure I had the new card before we moved. Well, you know it, we moved in August 2005 and still no card. I called once we were moved in and was told that they would check. In the meantime, I'm making automated payments on the card, in fact, I was about to pay it off again!
I called my bank, they confirm they sent the payment well before the due date and say they will called Capital One.
The bank managed to get Capital One to take back the late payment. Bank called me and told me that they told Capital One they were going to report them for holding on to a payment past the due date. Well, I got laid off in December 2008, close my bank account inFebruary 2009, stopped all automated payments. I ended up overpaying Capital One and they owed me money, think they called? Capital One changed my due date, causing a payment to be late. I called about that and tried to pay over the phone with my debit card. They refused saying that they only take another credit card or debit card with bank account information.
Funny how every other company will take a debit card for payment, like AT&T, Verizon, the gas company, electric company, garbage company and other credit cards. You send them what you can, trying not to be late and they still call and insist you pay them like $100 more than your payment, on top of what you paid. And how many of you have actually talked with someone who doesn't have an Asian, Hispanic or Indian accent? Oh, and I still have a card with a March 2005 expiration date on it. I couldn't use that card to save my life, but they can add whatever charges they want to it.
Today, I got a call from a local area code, the guy states he's calling from some tax place about Capital One. What? We got a tax refund so we don't owe any taxes. He starts out nice and then states that the State of Nevada will get their money. Sorry, I don't owe Nevada any money. Then he claims that the reason why I haven't gotten a job is because my credit rating is bad because I don't pay my bills. Sorry, again, Capital One is the only bill I've had a problem paying and I had a part time job in the meantime that my credit rating apparently had nothing to do with them hiring me. He got extremely insulting about my character and lifestyle, at which point, I hung up on him.
The bottom line is that I can't understand how a company can say that you have an open account when they have refused to actually give you an updated card, refuse payments over the phone, change your due date, charge you late fees and interest rates of almost 30%, harass you on the phone but say they have tried to work with you! I say that I should only have to pay my limit of $300 and then please, Capital One, cancel my card and never, ever contact me again! Without a steady income, the high interest rate, the company not accepting my payments over the phone with a valid debit card and secured by the State of Nevada, has caused the balance to more than double and the calls to be increasingly insulting. Capital One's practice of holding payments until late so they can charge the late charges has got to be illegal.

In the meantime, I used the card for monthly charges -- about $1,500 each month -- paid on time, in full. Despite this, they are now charging me interest.
Correspondence to the three top executives resulted in a meaningless letter from some lower level officer. They're making extra money and no one has sufficient ethics to rectify the situation. Trying to keep our credit at a decent level so that if the economy does turn around, we'll be able to buy a house again (since we had to sell ours to survive). I try to make a lump sum payment towards our debt (not a settlement payment! ) for Capital One to lower our interest rate which is just shy of 25%. They say no, "the only way to lower your interest rate is to make 12 consecutive payments on time." That's another 12 months of paying almost 25% in interest! No wonder the credit card companies aren't hurting!
I've had great success with Chase and with Discover. They will at least work with you so that you can try and keep your head above water, but not Captital One. I have been a Capital One cardholder for 10 years. In Feb 2010, I received a letter from them stating my "Introductory" APR expired. The net result was my rate immediately changed from a steady (for numerous years) 4.95% to 15.9%. After reading that letter, I immediately called their customer service line to ask (1) why since I have never exceeded by limit nor made a late payment and (2) what options did I have to get my rate back to what it was or at least lower.
I was told, "We understand your frustration but we apologize as there's nothing we can do at this time to lower your APR. Please call back next month to see if it's possible at that time to reduce your rate. In the meantime, I'll notate your account that you called to inquire about lowering your rate."
Since Feb 2010, I called each month with the same question and was literally given the exact same (scripted) reply. In the meantime, my monthly minimum payment more than doubled to Capital One. I've struggled but paid each one and did so on time. July 2010, after six months of struggling and calling Capital One, I called again with the same question and was told by "Seth" that I could "Opt-out of the new terms" that caused my APR to jump.
I immediately reacted, informing him that I've been asking this question for six months. Why only now was I offered this wonderful news? His answer: "We are discouraged from telling customers about the opt-out option which also places your account in restricted status."
I asked, what "restricted status" meant and he clarified that "the card could no longer be used for purchases but would reinstate your original APR of 4.95%. "I nearly shouted "perfect! " when he told me this news. He said he would need to transfer me to a "senior account specialist" to complete my opt-out request.
I waited approximately 5 minutes and another gentlemen took over the call. He was quick to tell me: "You've unfortunately missed the window of opportunity to opt-out of the new terms and, therefore, you are stuck (he actually said stuck) with the new APR of 15.9%"
I was livid. I told him how I've called for six consecutive months asking how I can get my old APR of 4.95% back but was told to call back. And that my inquiry would be noted on my account. He proceeded to tell me "I'm sorry but there's no record of you ever calling to ask about your APR or any other reason". If I could have jumped through the phone to strangle someone at Capital One, I would have. I told him this is a scam and that I would be blogging this online on as many websites as I could locate.
He said, "I would do the same if I was in your situation". Either way, Capital One are running a dirty business of lending. Just Google "Capital One screwed" and you'll find a ton of posts like mine. On July 5th, I went on-line to make a payment for August and I noticed four charges on my card. I called Capital One and told them I have not used my card since cancelling, and I wanted to know why they were allowing charges on a card I cancelled; Frankie, from customer service, tells me that it might be a charge from before I cancelled the card and the company was holding it. The next day, July 6th, I go on-line to see if the charge was adjusted and noticed that the same company had charged my card again after talking to customer service on the 5th. I sent a message and disputed the charge once again and told them to stop allowing charges on my cancelled card!

I have been fighting with Capital One ever since I bought a car for my girlfriend. I took out a loan in my name with the understanding that she would make the payments. Initially, she tried to make the payments online herself using my log in information for the website. Due to the website keeping track of the IP address being used to log in from, she was constantly getting locked out and the payment that she did make online was lost.
The ACH shows as being deducted from her account but Capital One says they never received the payment. Additionally, as near as I can tell, the payments they require is for the month in advance. So in other words, if you fall a month behind on your May payment which is due on May 14th, then by May 20th, you will have already received a statement saying that you are now 2 months behind in addition to the appropriate late fees to reflect that even though the June 14th payment isn't even due yet.
To that effect, they have already started repossession proceedings when the last payment that was made was in April and they are now showing the account 90 days past due. Additionally, the repo man who just showed up at my house showed me the statement showing that the vehicle is 90 days past due and it's only the 15th of the month. They are using this to repossess the vehicle when the payment due date has just been reached and they expect the payment for the month in advance?
On top of that, they are now showing $500 in late fees. In Dec of 2009, I made arrangements with one of their supervisors over the phone to pre-schedule 4 payments of $400 from Dec until April. The payments were deducted from my checking account. The payments were processed and approved but since the payments were made through some form of third party, the systems at Capital One did not register as a monthly payment. In January of 2010, I did not receive a statement so I was under the assumption that all is well. Then in Feb, I received a statement showing that I was a month behind with late fees.
After half an hour of arguing with Capital One over the phone they assured me that everything was fine and once the final payment was processed in April that the system would catch up. Again in March, I was on the phone with Capital One and again, was assured that when the final payment was posted that everything would be caught up. The final payment was made and the following month I received a statement saying that the account was now 2 months past due and had $300 worth of late fees.
I contacted Capital One and advised them of the situation and was told that the amounts were correct and when could they expect payment. First they said that the account was actually 2 months past due and then said that the ACH payments actually caught me up since March and not April. I stated okay that's fine but it is now May 21st and even if that were the case if the account had been caught up and paid in full effective as of March 14th, how do they then justify $300 worth of late fees for the 2 month period? At $15 per month, that is $30 not $298. The answer I was given each time was the amount is correct, pay the bill.
Not only did they manage to charge me the late fees from Dec to Apr at an additional $86 per month but on top of that, they are trying to charge me the same late fees a second time and expect payment. They refuse to acknowledge my claims and will not even give credence to anything I say. No investigation, no resolution, just pay the bill. I am doing everything humanly possible under the circumstances to pay the bills that I actually owe without being held accountable for bills that are not even mine.
I did not mind picking up the slack and helping out my girlfriend when she fell behind but every time she falls a month behind, it ends up costing me a thousand dollars. I do not understand how they get their math? Currently they show the amount due as $1,600 for a car payment that is $312 per month x 3 months. By my count that amounts to $931 so where do they get $1,600? And to make matters worse every time I call them, the payment information changes to conveniently match their numbers.

I received my new "low-limit" Capital One Mastercard in the mail just yesterday. I called the number on the sticker to activate it. Less than 5 hours after that, it wouldn't work. I tried again today, and it still wouldn't work. When I called up the number located on the back of my card, the lady on the other end said that my card had attempts of being fraudulently used. Then she told me that to enable it to get my card back to working order. Their fraud department would need copies of the following:
Verification of Income (recent paystub)
Most recent checking account statement
Verification of my address (w/a bill)
Copy of my Lease Agreement
Handwritten full name
and my 16-digit account number
This is unheard of! I've had fraudulent uses with other credit cards, and they never request this information! My 1st instinct was to close the account immediately, but the lady told me that until they received this information, they would not be able to close my account. I'm really not sure what to do about this now. I refuse to pay any charges that are happening on my account should a bill come with them on there!

I made some purchases in April 2010. In May, I paid them but leaving a balance of about $1450, which was supposed to be paid in full in order to avoid Interest. However, I overlooked it and they charged me $27.09 on June 8, 09. I called on June 10th requesting a waive for that Interest. They couldn't do anything. So I was just "Forget about it. I will pay the full balance." So I made a full balance payment of $1526.13 on 6/10/10. Every charges after that, I paid it right away.
July 8, the new billing cycle, I saw an other interest charge. Because I had a charge from Toronto, so I thought that maybe the International charge fee, but it wasn't. I called Capital One's Customer service. The first rep was willing to waive that immediately. I thought that they can't do anything to Interest charge! However, I wasn't satisfied with that. I think it was a mistake. So I asked to talked to the manager. She explained to me again and again that was an interest charge for balance that carried forward and, you only see it on the billing cycle date.
The bottom line is when I made a full balance payment on June 10 that didn't take care of everything. There is still accrued interest charge that I won't be able to see until the new billing cycle date. I believe they knew that it was a mistake at their end. That 's why they were willing to waive that immediately. But what if I thought I have $0 balance and I don't check, would that go unnoticed for month? Then they will charge me late me, and interest, and interest on those fees. It's is ridiculous. I have Discover Cards and it never happen to me like that. Capital One is not a good credit card to have.

I got laid off from my job and called Capital One to see if I could do something to save my car as I could no longer afford a $750 car note which held a 16+% interest rate as I was considered a subprime borrower. Even though I owned a condo and was making $35 an hour as a construction laborer. (That’s another story) I entered into a direct pay program where I was making payments every two weeks when I received my unemployment and it was directly withdrew from my checking account. This was their only solution to my request for help. I went to their web site and checked my payment history as my principal balance had not decreased by much in six months. I check my payment history on-line and found that all of the payments in this plan had allotted the majority to interest.
I'm just wondering why a program they instituted to help you is actually a way of helping them get over on interest. Why even have the program and how could I owe more interest when I'm paying every two weeks. I told them to cancel me from the program and I'll pay them when I can as it did nothing to help me; it only exploited my circumstances. I used every means of trying to rectify this loan. I asked them if I could put the missed payment at the end so as not to jeopardize my credit report and consequently owe more late fees and etc. They told me no. You can only put one payment a year at the end and that’s with a fee. I asked to do that and they told me I'm not eligible until July 25th. Until that time I'm being harassed and bombarded with interest even though they are exacting $35 each month as late fees, which now amounts to $473.69. Capitalized as payment due and charged interest capitalized daily. So for one month because I'm a month behind the summary looks like this.

For me to call back on July 1, 2010, I called my bank. They said the funds cleared a week ago. I called back on July 1, 2010. They still had my funds on hold and I asked them why they need personal documents to be sent to them. I asked them to close my account they did not want to close it. They advised me to call back next week. I called the corporation office. They said they will finally send my funds to me.
I ask them to send it to a P.O. Box instead of the address they said. They cannot send it to the P.O. Box. They have to send it to that address. I explained to the lady that at this time, I am not at the address to ensure for me to receive my money please send it to the P.O. Box. They refused and now I have $500.00 sent to my address and I am not home. I feel they are not a good company. Any company will send the check to person that is requesting.

We have deposited three checks monthly for the past 5 years, totaling $1,000, and cash, a personal check for expenses. On June 4, 2010, we made the deposit at the drive-up window. We had never seen this young woman before. She supposedly took care of the deposit and returned an envelope to us. We put the envelope away without checking. We did not look in the envelope until June 24, at which time we discovered that there was no cash and two of the 3 checks were gone, leaving one check in the amount of $500.00 and a blank check for the cash.
Bringing the envelope into the bank, I was told that they could not do anything due to the fact that I could not produce a deposit slip. The teller said that she never saw a deposit slip which was untrue. I questioned this by saying, if she left another check to be deposited, why did she not ask for a deposit slip or say she could not deposit without a slip. We called the issuing company who said they could stop payment and issue new checks, but two checks totaling $500.00 had been cashed. The bank is now insisting that we were given the cash. The computer says they gave it to us, but who programmed the computer?
Each check had "For Deposit" written on it. If she did not have a deposit slip as she claimed, why did she not inform us immediately that we needed one. I know that I included a deposit slip as I always do and I do not know what she did with it. When I asked why she did not ask for a deposit, I was given the silly answer, "Many of our customers deposit without a slip". So why did our deposit go awry?

All other credit companies have offered lower rates and payments to help consumers with debt. I find it disgusting that they are making 18% off of me for years they have gotten their money ten fold. I want to pay my debt, but they have made it impossible at 18%! I closed my account and will be forced to do debt consolidation which will hurt my credit and they will end up getting zero dollars!

A month later, the account was still open, and for the second time, I'm obliged to pay the exorbitant minimum payment at the exorbitant APR. Capital One did not keep their own terms and agreement. Consequently, I have to pay an increase of ~$40 per month (from ~$68 to ~$108). I lost $40 because they failed to close the account. I already lost $40 on the first month they changed the APR from 7.9% to 17.9%.

My statement reflects no itemized fees but the exchange rate for the charge in Euros was more than 25% higher than the published exchange rate (1.557 versus 1.19). Capital One raised the interest rate on my credit card from 11.9% to 17.9%, stating that I didn't respond to their opt out notification sent over a year ago. I'm looking at retiring in the next few years and I am feverishly trying to pay off all my debt, some self-incurred but most as a result of a divorce. When I called Capital One, the foreigner on the other end of the line stated that there's nothing anyone can do to change the interest rate. When I spoke to the supervisor, I was told the same thing. The change in interest rate means that now only one-third of my monthly payment goes to pay principal and two-thirds to interest. This change is really making it difficult to make ends meet. This is criminal.

I have had similar problems with Capital One that the other posters have documented, such as holding payment in order to be able to assess a late fee. However, my current problem is that I phoned Capital One to get a payoff balance and to pay off my card balance. I paid my card off over the phone and now I get a bill for $49 for interest! I stated that I paid the total balance quoted to me, but the representative went on and on about interest and refused to credit the amount. I asked to speak to a supervisor and stated that I had paid off my entire balance and now received a bill, but they wouldn't help either. It is interesting to note that my bill goes to Charlotte, NC but all of the representatives that I spoke with had heavy accents that were hard to understand. The American names such as "Nicole" do not fool me. You get what you pay for Capital One, and these workers are not providing any kind of good service or clear communication. I do not think that it is legal to quote a pay off amount, have a person pay off the total, and then decide that there are additional fees.

I've had my account (in perfect standing) with Capital One for eleven years. I submitted a balance transfer from one of my husband's cards last week, which was approved. The very next day, I received a phone call from Capital One, advising me that they were lowering my credit limit, and could not tell me the reason on the phone. I flipped out, told them that they had just approved my balance transfer, and now they lowered my limit the balance transfer would then put me over the limit by a nice sum. I then informed them that I would be immediately be contacting the NYS Attorney General's office. They asked me to hold. I agreed. They said they would honor the balance transfer without adversely affecting me, but that the new reduced limit would stay.
I called Capital One at 12:30 AM, I couldn't sleep. I asked them if, because my account is in perfect standing, if they would reduce my interest rate. She put me on hold for a full 30 minutes! This company has never been so disgusting! When the very disinterested, very rude young man came to the phone (he was supposedly a supervisor), I asked to speak to another supervisor. He said he was all there was, and refused to put me through to anyone else. I did not sleep last night. I feel as though I'm being treated no differently than a person who either can not, or refuses to pay their bills!
If I hadn't threatened them with the attorney general, I imagine that the financial consequences could have been dire. I have very good credit, and it could have ruined it. I've experienced no physical damage, but I have been so preoccupied with this that I can't sleep, and it's constantly on my mind! What if my other credit cards begin doing the same thing? I'm trying very hard to find a way to get this bill paid off ASAP, even of it means applying for a new card to transfer the balance to.

I opened a MasterCard charge card with Capital One in 2008. In that time, I have never had a late charge or gone over my balance, and I have always paid more than the required amount. I have good credit score. In May of 2010, Capital One raised my interest rate on purchases from 8.90% to 17.90%. I called the company on June 25, 2010 and again on June 26, 2010 to find out why. I was told by (Rain) that the company changed their interest rates for everyone across the board.
I told her I didn’t think that was fair since I have been a good customer and paid on time. She agreed, but said there was nothing that could be done except for me to speak to an account specialist, but they were closed and I had to call back tomorrow. I did call back on the 26th and spoke to (Daniel), an account supervisor. He told me sorry, but he was unable to make any changes at this time and I was just stuck with the current interest rate. I asked for an account specialist, Daniel told me there was no such person. I asked for someone else to talk to over him and I was transferred to (Paula), a snotty woman with a southern accent who told me the only thing I could do was close my account.
I am shocked and disgusted at this comment. How can a large company who survives on customers treat customers so bad? I want to start a class action suit against Capital One MasterCard and get this interest rate reversed and all the money they stole from me back and make them stop doing this to good customers. By Capital One raising my interest rate like I am a bad customer, it will affect my credit rating and provide an opportunity for all my cards to do the same. This is unfair and, if it is, it should be illegal. Their greedy actions can have lasting impact on my credit score and my life. This is robbery and I think they are acting like mobsters.
Next, I would expect a hit man come to my house and try to make me stop complaining and just take the financial screwing like a good sheep. I can understand raising the interest rate of customers that are behind, but to do this to paying customers with good credit is unthinkable. This company should be punished for doing this to Americans in this time of economic struggle. If we want this economy to turn around, then we need to stop these giants who feel they are above the law and common decency to stop trying to extort the citizens of this once great country. If you are an attorney and can help with this, please contact me. I am sure there are others out there that would join in the complaint.

In Feb. 2010, the payment for my account was received after 5pm of the day it was due according to the representative I spoke to on the phone, June 25, 2010 3:30pm eastern time. He removed the late fee but said he was unable to remove the late payment on the account. As a result he was not able to lower my interest rate. He told me that with the new federal laws Capital One now only needs 6 months of on time payments to lower the rate, but since I was still being effected by the policy prior and there was a late fee assessed in Feb the rate would stay at 23% until October of 2010.
I asked him to give me an address of someone who I could write to, to have this managed and he told me there was no one who could change it. So then he spoke to a manager who told him if I had not had the late payment in Feb. that I could have the lower rate now instead of Oct. So I asked if I could speak to his manager. He told me there was nothing he could do for me but put me on hold. I was on hold and then disconnected. This seems a little strange and well to the advantage of the bank to keep the higher rate until October based on a late payment that arrived on the following day. My payments are made via e-banking from my savings account.

I am writing to complain about the No Hassle travel I booked through my Capital One redemption program. Please note this is the first time I have attempted to redeem any miles or rewards. Chronology of Events:
1. June 9, 2010. I purchased a round trip airfare from Minneapolis to Chicago for June 19 June 21, 2010. I was going to visit my father, in Champaign, Illinois, for Father’s Day. I also rented a car in Chicago to make the 150 mile drive to Champaign.
2. June 19, 2010. My flight was scheduled to leave on Delta flight 2207 at 5:00 p.m. As I approached the airport, I got a recorded phone message saying my flight was cancelled due to mechanical problems. The recording contained no information about alternative flights. I continued to the airport, sought out a Delta ticket agent, and asked to be put on the next flight out. At first she said there were no vacant seats, and I would have to wait until 6/20/10 to depart. When I explained my plans and complained about the last two Delta flight delays I had experienced in the last 6 weeks, she found a seat for me on a 7:00 p.m. flight.
3. June 19, 2010. I waited for my 7:00 p.m. flight. It was delayed until 8:15 p.m. I boarded the delayed flight; we pulled away from the gate, and sat on the tarmac for about an hour. The captain said there was bad weather in Chicago, but we would leave when it passed. In another 15 minutes, the Captain said we could not leave because the flight crew had worked their maximum 15 hours/day, so we were going to return to a gate and get a new crew. But there were no gates open, so more waiting. Finally we returned to the airport, but they had not found another crew. We were directed to return the next morning, 6/20/10, to board a 7:00 a.m. flight. They explained our luggage would be sent ahead to OHare Airport. 4. June 20, 2010. I arrived at the Minneapolis airport at 5:45 a.m. The flight was delayed and we left at 8:15 a.m. When we got to OHare, our luggage was nowhere to be found. We waited another 45 minutes before our luggage arrived. Mind you I had now missed the family golf tournament. The only reason I had checked baggage was because I took my golf clubs for the tournament. So I wasted $50 carting my clubs back and forth for no reason.
5. I picked up my rental car and still had to pay for two full days because I would now have the car for all of 26 hours. 6. I got an early start on Sunday from Champaign, Illinois to drive to Chicago to make sure I had plenty of time to board and check my bag. My flight from OHare to Minneapolis was scheduled on United Airlines, flight 687. I waited in line to complete the online check-in, but the computer would not recognize my reservation. I repeatedly asked the ticket agent for assistance. Four ticket agents went out of their way to either completely ignore my requests, or disrespectfully tell me to use the online check-in process. I told the ticket agent I had tried and it didn’t work. I was required to stand in another line, and when I finally got to the ticket agent, she looked up my reservation and told me my reservation had been cancelled. Not my flight, my reservation. I told her that was impossible and I showed her my e-ticket receipt sent by Capital One. The United ticket agent looked it up and said that Delta had transferred my reservation to American Eagle Airline. She directed me to run from Terminal One to Terminal Three to quickly check-in on my new American eagle flight.
7. I ran to Terminal Three, dragging my heavy golf bag, hoping I would get there in time to catch the flight. I attempted to check-in online, but again got a message to see the ticket agent. I stood in a very long line for just under an hour, and finally asked the ticket agent to issue me a boarding pass. The ticket agent looked up my reservation and said American airlines did not have a reservation for me. He attempted to call both American and Delta airlines, but neither answered his calls. He suggested I return to United and make them put me on a flight. But he checked and the remaining united flights were all full. I was desperate at this point to get on a plane and get home, so I purchased a one-way ticket on American and arrived in Minneapolis at 9:30 p.m. on flight 609. I paid $260.70 for the flight.
8. Had I chosen to just purchase a flight for my Father’s Day trip, I could have booked a flight on Southwest for $158, roundtrip. As it stands, I am out 35,000 miles and $260.70. 9. I contacted Capital One service desk on Monday, June 22, 2010. I was put on hold twice for a total of 75 minutes. In the end, I was told Capital One would reimburse me 15,000 miles for my trouble.
This seems like an insufficient settlement and totally unacceptable to me. Please either refund my full 35,000 miles, or repay me the $260.70, or cancel my credit card. If you review my record, you will see that I am a loyal customer, I promptly pay my bills, and I travel frequently, and expect far better treatment than I received from Capital One, Delta Airlines and United Airlines.

I paid my credit card debt in full with Capital One in Feb 2010. I spoke with one of their representatives on the phone and got the exact payoff amount. I was very adamant that I wanted the account closed. My bank account was debited. However, every single month since then, I have continued to receive bills from them for various fees or charges on a closed account. Each month, I have spent at least 15 minutes on the phone giving a different person the exact same information, only to be assured that it was mistake, that the account was closed and said that "I will not receive any bills in the future". I have asked repeatedly for them to send me a statement reflecting that the bill has been billed. The response is always the same, "this is not company's policy, however, you will not receive any bills in the future". Yet every month I do.
Most recently, I received a letter dated June 10 for a balance of $35.92. The letter actually states "because there has been no activity on your card, you may not have noticed a past due amount resulting from your Annual Membership Fee". Then it goes on to threaten closing the account, which originally was closed in Feb and I have confirmed this every time I have called. I have repeatedly asked, "How do I have a membership fee on a closed account?" and each time, their response is that it was a mistake and the fees will be adjusted. It is so frustrating. I don't have the time (or patience) to call each month and worse, I'm concerned that this is negatively affecting my credit since the bills mention a "past due amount".
I don't know if some people just give up and pay it. I would appreciate any help you can offer. I want the bills to stop and for the record to reflect that my card was paid and closed in Feb 2010 and that there are no past due amounts owed. Economically, I am concerned about the bogus bills negatively affecting my credit score.

I received an offer from Capitol One in the mail. After much thinking, I finally applied for their card online. My card arrived several days later. It had a sticker on the front, saying I had to call and activate it. I called and answered a whole slew of questions the operator had. Upon asking if I would be interested in the credit card protection package for $.99 per $100 balance, I replied "yes".
She then asked me if I was employed. I told her I was self employed. Her reply was , "oh"…then she proceeded with just several more questions. I decided I would go online and sign up for Capitol One’s online banking. Upon signing up, I learned that even though I had a $300 credit limit, I had no available credit. I called customer service to find out why.
Well, long story short, they had flagged my account for possible fraud, because I told them I was self employed! They wanted me to send in a copy of my driver’s license, bills in my name, last year’s income taxes, and a bank statement for both checking and savings. For a $300 credit limit, I don't think so! Well, I checked my email just now, and I had an alert from Capitol One. They had charged my account $39.99 for the annual fee, on a credit card that I'm not even allowed to use.
I called them immediately, and told them to cancel the card. She didn't ask me why, but I told her anyhow. She seemed to have cared less. She didn't say a word. She just said she would cancel it, and report to the credit bureaus that the account had been closed within 30 days. She said the fee would be taken off of the card, and it would show a "0" balance. I have had credit cards for years, and have never been flagged for fraud. I am outraged! There are other companies out there besides Capitol One!

Would you believe that after calling the 1-800 number, the call continued to be routed overseas? Even after insisting that I wanted an American based agent, they tried to convince me that I was being forwarded to an American based Customer Service Rep. We Americans can tell the difference. Don't you just love it when they use an American name, but sound foreign? So the question here is, does Capital One hire American based C/S Representatives?
I have a very strong feeling that they will somehow make an excuse and charge me some type of fee and attempt to hike my interest rate. After all, they aren't making that much of an investment from me, being that my interest rate is 3.12%. If this should that happen, a formal complaint will be submitted to Lisa Madigan, Illinois State Attorney General.

I had used my Capital One credit card and taken it close to the limit. I made my payment and like others, the payment was not processed in time and I received a late fee. I was willing to accept the late fee, I felt like, well, I should have gotten it in a day earlier. However, because of the late fee, it put my account over the limit and I was charged an over the limit fee. This was not on one card but 3 cards that I had with them. I called and argued that the over the limit fee was from them, charging me a late fee not from me taking my account over the limit. They were unconcerned. They would not waive the fee.
I asked to speak to supervisors and they would never let me speak to anyone. They would take my name and number and no one would ever call back. I said I would make a payment, but I did not want it to apply to the over the limit fee, until I was able to talk to a supervisor and they would not comply. They said that the payment had to go towards the fees first, then the balance. So out of frustration, I refused to pay. Not a very smart idea. Now my credit is completely ruined. The balances are now more than doubled the original amounts and I get calls every day. They are willing to settle for slightly more than the original amount owed in one full payment, showing a settlement on my credit report which will do my credit no good. I feel like I am in a Catch 22. No way to win.

I paid the balance of my card off in June of 2009. In May, I received a notice about an annual fee of $59. So I called them to ask them to waive the fee. They told me that, in addition to the annual fee, they have also charged me a late fee on the membership fee. After much talking, they agreed to waive the fees. I got off the call thinking that I didn't owe them any money and that next year they would not waive the fee. The next thing I know I'm checking my credit and see that they are reporting me 30 days late for a balance of $74 dollars. Come to find out, they didn't waive the fees and now have reported a negative report on my credit.
When I called them to find out what happened, they tell me that they never agreed to waive the annual fee, but only the late fee that they charged me on the annual fee. So now, I have a 30 late report on an annual fee + late fee on an account that I have not used and paid off a year ago. I feel like they lied to me and tricked me into this terrible situation. I will never use this card again and I advise people to not get involved with this company. Of course, I paid it immediately because they are not trust worthy. They have put a negative report on my credit report, showing 30 days delinquent for not paying the annual fee plus a late charge on the annual fee a total of $74 dollars. This will be on my report for 7 years.

I have a Capital One Card with a $500 limit since 2007. I paid on time until I got divorced and ended up making about 1/3 of the income I used to make with my ex. I explained this to them and I paid as often as I possibly could, but circumstances were dire at the time. I am still (although 3 years later) struggling to get on my feet and still hoping I can eventually.
Meanwhile, Capital One is charging me over limit fees, late fees and service charges every month. The balance is now $1,700.00 and these people want it all at once. I have talked to them and they told me they would put me on a "hardship", which would eliminate these charges for 3 to 6 months. That never happened. They turned my account over to a collection agency who said they would work with me, but wanted me to pay $400 at a time in 3 payments. There was no way I could possibly do that amount of money.
I have paid them money in the mean time and yet the balance keeps going up! I don't know what to do. They won't accept payments of $50 at a time. They won't stop the service charges and they get down right nasty with me on the phone, explaining that none of this would have happened if I had just paid my bill on time. I would have paid my bill on time if I had the means to do so. I don't know what to do, I am at the end of my rope.

After having these credit cards for several years 1 ML, 1 Capital One and four Chase cards, I kept them just below the limit which was $15,000 on the ML and $12,000 on the Capital One, $900 on one Chase, $350 and $250 on the other two Chase cards.
I decided that since they raised my interest rates from 9-12% to 29.99%, I paid them off. Chase canceled 3 of my cards, and left me with one with a $250 limit. In the case of ML, they decreased my limit to only $8,000 from $15,000 and Capital One business card from $12,000 to $8,000. I have done research and found that credit card companies are penalizing those who live in areas of abundant foreclosures. In other words, we who pay our debt are paying for those who don't.
Another thing I found out was that Capital One was not giving out credit limit information until a class action lawsuit arises. It seems they don't want us to qualify for credit. By decreasing my available credit, they have lowered my debt ration which in return lowered my FICO score and for what? Paying off my debt? There should be a lawsuit against this.

Capital One states that based on my account history which has been late (never past 30 days), they have increased my interest rate to 29.4 %. My account has never been over 30 days late. They failed to send me a statement to my current address after I moved. They were contacted with the address change and the post office change of address was also completed. From the complaints I have viewed, it appears that Capital One intentionally posts payments late and then penalizes the consumer. I contacted the company and requested that the interest rate be reduced, that I’ve never been over 30 days late, and they said no, that my account has been late (within days) and they would not adjust the rate. Lastly, the customer service department is located out of the United States and the customer service agents do not understand English very well.

I have had a Capital One credit card at 9.9% interest for many, many years. My local newspaper and Netflix were charged to the account on a monthly basis. I am also paying down a large balance on this card (the balance is below my credit limit). I have always paid more than the minimum balance and have not missed or been late with payments. In April I received a notice that my "promotional" rate would end and my new interest rate would go up to 17.9%. When the new rate finally showed up on this month's bill, I called Capital One to ask that they consider lowering it because based on the information on their website, I should at least qualify for the 14.9% rate. I was told that the rate could not be lowered and that there was nothing else they could do. Because of the increased interest rate, 60% of my monthly payment goes to interest alone. The minimum monthly payment also increased too close to the amount I already am sending them. I can't afford to make larger monthly payments. I just can't believe that this is how good customers are treated. I will never do business with this bank.

On today's date, I received a call from the above subject who informed me I had only one option and that was to make a payment by the end of June in the amount of $350. I told this gentleman I could only pay $100 by the end of June but could make arrangements to help settle this debt beginning in July. He placed me on hold for 10 minutes, I hung up.
He called over 8 times in a row, not leaving a message. Then he called my husband’s cell phone and left a threatening message (we still have it available if you need it). When my husband called him back to advise he has nothing to do with my finances and how Mr. Chris ** got his cell number, he told him it was a matter of public record (AT&T in fact, denies this).
I called Chris to inform him that he needn't call my husband with my personal issues and he got very hostile and angry with me. He raised his voice and began to speak over me, speaking critically to me and in an intimidating manner. I told him I was calling back to speak to his supervisor. I tried unsuccessfully 6 times to reach his supervisor to ask that someone less threatening and hostile takeover my account. Each time I was sent back to Chris despite asking not to be where he again, was angry and intimidating. 2 different times I was literally just hung up upon. I applied for and received a Capital One Visa card a few years ago and would like to share my experiences with them. It didn't matter when you sent the payment, you are always late. One month I sent in my payment 2 weeks early and it was still recorded as late. It was supposed to be a Platinum card, but only had a $750 line of credit. I needed some equipment for a hobby of mine and over a period of about 2 weeks put about $600 on the card intending to pay in full when the bill came due. To my surprise, they added a fee of over $150 and said I'd exceeded my limit and charged me an over limit fee of $59.
I contacted them by phone and was told there was nothing they could do about it and I needed to pay the amount in full. I asked for and received the total and promptly paid them, though I was not too happy with the whole situation. A few days later, I received a phone call saying my payment was late and I had to pay a $39 late fee, which I did. I tried unsuccessfully to get them to cancel the card. The time came when I needed some more stuff for my hobby and against my better judgment, I resorted to their card. Once again, the late fees and other assorted fees were tacked on, and this time, I refused to pay them. I paid what I owed them, but I wouldn't pay the excessive fees.
They continued adding fees and late charges after I destroyed the card and stopped using it. On Friday, 11 June 2010, I was served with a civil summons by a county sheriff’s deputy saying I was being sued by Capital One Bank USA for $1587.45 plus $238.11 for court costs and attorney fees. I have 20 days to respond or they could find judgment against me by default.

In 2009, I reached out to get assistance for charges on my account that I did not authorize. The charges were removed by a representative. Thereafter, the charges were re-populated and I was once again charged for the disputed charges, along with the new charges I placed on the account. The representative claimed I was supposed to fill out a fraud dispute form, so the charges were re-credited. This action put the account over the limit. I have spoken with several representatives to resolve this issue, but to no avail. I was sent a dispute form to document the charges I disputed. It apparently was not honored, because nothing was done.
After several weeks, I contacted Capital One, and was told until the info is verified, I should continue to make my regular payments. It's been several months since then, and it does not seem like anything will manifest. My financial situation would not allow me to make the kind of payment I would like, to rid myself of this issue. At this point, I was once again informed that my account status prevents them from assisting me in this matter. However, the problem was created by Capital One, when they removed the charges, and re-applied the charges, and did not honor their own resolution for an issue like this. This hinders my chances of receiving loans, or other assistance from Capital One Bank.

The first person I spoke to laughed at me when I asked if we could work out payments. I told him that all my other creditors worked out a plan, and he responded by telling me that Capital One wasn't tied to the agreement that other creditors were, because they weren't tied down with the government plans. So, after a month of not paying them I called again and the woman I talked to said they could help me if I just pay the amount due that month. I paid them then called and again was treated like a circus flea.
My Capital One payment due grows a lot every month. I told them that if they didn't treat me with some respect and work something out with the payments (I played the "you pay and I'll be helpful game several times), I wouldn't pay them at all. Unlike many of the other stories here, I never defaulted on my credit card payments to Capital One. After many credit mistakes in my early 20's, I worked very hard for the past 5+ years in paying my debt off/down and making payments on time. I am one of the fortunate who have not lost their job or had an "economic downturn" in my life and even recently purchased my first home last year. After being a customer with Capital One for 2 years, I received a slap to the face when I saw they raised my variable APR from 8.9% to 18.9% for no reason.
When I called to question the increase, I was told because of the "current economic conditions" they raised their APR on many customers. I was told not to take it personal (ya know, cuz it wasn't just me they screwed over) and they had actually sent a letter over a year ago advising me of the change. Really? I'm supposed to remember one letter you sent me over a year ago telling me you were going to raise my APR for no reason? Oh wait, there is a reason. Because of the recent government regulations on credit cards regarding fees, they have to make up their money somehow, right? Well, this is how Capital One is handling it.
I was finally able to get through to a supervisor at Capital One who agreed to decrease my APR down to 10.9%, still 2 points higher than it was previously, but better than the 18.9% they tried to screw me over with. Of course, this rate is only good for 6 months and after that it will go back up. This is the reward or thanks I get for being a responsible consumer? For making my payments on time and taking my credit seriously? Shame on you Capital One for screwing over a good customer. I will be transferring my balance to another company as soon as possible. After reading all of the fine print of course and making sure my APR won't be double digits after the introductory 0% balance transfer deals they give you for the first year. Increased payments after the interest rate more than doubled.

The settlement agreement laid out by Capital One is as follows, "The calls you received were intended only for the purposes of discussing a payment arrangement and are not meant to be harassing in any way. We regret that you are dissatisfied with the service you have received; however, you may be assured that Capital One and any company retained to collect the debt on our behalf must adhere to all applicable rules and regulations when contacting a customer about an account that is delinquent or over limit.
We have removed your telephone number from our call lists regarding the collection of this debt. We will continue to send monthly statements and any other written correspondence, as we are required under current regulations. If your account becomes over limit or delinquent after being brought current, it is possible that you may be contacted again.
As a gesture of customer goodwill, we have issued credit for the $39.00 Past Due Fee assessed on May 6, 2010. This credit will appear on the June 2010 billing statement. Please be advised that a Past Due Fee is assessed in accordance with the Customer Agreement if the minimum payment is not received by the due date.
Additionally, if an account exceeds 30 days past due, the delinquency is sent to the credit reporting agencies. As of May 28, 2010, the account is 19 days past due. To prevent this current delinquency from reaching 30 days past due, a payment of at least $7.49 must be received prior to June 9, 2010. However, to avoid an additional Past Due Fee, the entire minimum payment of $88.49 needs to be received no later than June 6, 2010.

He seemed very kind and I thanked him. Scott set up three scheduled payments of $556.87 with a $35 fee for an extension which will extend my maturity date to 05/19/2014. There would be two payments made in February and one payment in March. The $35 fee was agreed to be drafted with the second payment in February.
Apparently, Capital One failed on their part to draft the $35 from my account therefore quickly started phone calls to my residence stating that I failed to make the payment so I defaulted on the agreement and demanded the total amount in full. No questions asked even after paying the three scheduled payments. Upon trying to work with Capital One and trying to get them to see that it was their error by asking them to read their notes or find Scott, the account manager, who made the arrangement to no avail. End Result is Capital One was not happy enough to tell me, a single mother who was trying to work with them, that they could help me by offering me an extension so they could get three payments then came after me to tell me I defaulted in the agreement so now they want all the money. I didn't have all the money so Capital One took my vehicle from me and my children after I did my part. They lied. My children and I were left without a vehicle since 05/21/10. It was the Collections Dept for Capital One demanding immediate minimal payment on my card. The payment due date is June 6, 2010. They threatened to send it to a collection agency and ruin my credit report if I did not pay the $88 and change, today! They said it was because I have been delinquent in payment.
I had no balance in March 2010. In April, I had a balance of $7.49 for which I never received an e-statement. In May 2010, I received a statement for $2,232.96, including a late fee of $39 (for missed payment of $7.49). I had to put my Dental surgery on the card on 4/29 for $1,408.35, 4/30 for $750, 5/3 for $50. These charges are applied to the June bill seen on the May statement. But now, I am being hunted down by bounty hunters to pay this early.
I had seen on your web site that there are numerous complaints against Capital One similar to mine. And furthermore, my complaint extends to this. Over the last 1-1.5 yrs during which time, I have been charged late payments. I thought I was going crazy that I hadn't seen or paid them. But as like the other complainants, either my payment was purposely held up to be late or I never received the E-statement.
I find this practice of demanding and threatening to ruin someone's good credit because they did not receive a statement for $7.49, therefore did not pay it, being charged a $39 late fee (for $7.49) disgusting. I think their practices should be further looked into! I wish to file a complaint and would like to know where else I can voice this complaint so that something can be done about their malpractice.

Recently, my Capital One bill went up $20.00. When I called about it, I was told that the fees went up and when I asked why my monthly payments are so high, I was told about the Payment Protection plan I signed up for in 2008. I told her never authorized this. They signed me up without my permission which is illegal. So they connected me to the payment protection people. I told them I never signed up for this and they said I did. So I told them to cancel it and the woman started telling me about the benefits and I stopped and said cancel or I go the my Attorney General. She promptly canceled it but since I had this card "2002" the interest rate has gone from 9.2 to 29.00. I can't wait to win the lottery. Until then, I will tell my story to my local paper and I'll send a letter to the ill Attorney General and my congressman. I can't even cancel this card until I pay it off. If you have this card, cut it up.

I am permanently disabled and receiving long term disability through Prudential since 2008. I never missed a payment with Capitol One until I became ill that same year in May 2008. I had credit card protection since I opened the account. I thought it was activated as I requested but it never was, said they never got the paperwork. The bill has now inflated from $369.07 to over $1300 plus court and other fees. I have not been able to do much of anything until recent months. I did contact their attorneys in January of this year to work out payment, but they chose to sue me. We went before the judge on 4/21/10 and I told the judge everything and I felt basically ignored. She didn't even know what credit card protection was (people who don't intend to pay their bills don't have credit card protection).
Their attorney said the card protection was from an independent company when on every bill it says: Card protection provided by Capitol One. I don't have a copy of the form requesting the activation because I was very sick and I never thought I would need protection against them. I did everything they asked me to do and until recently, I could not think of anything but getting well. I trusted them to do what I paid them to do - protect me. They did not. I have a new court date of 6/2/10. I understand and I admit this is my bill, but I don't feel I should have to pay 10 times that amount because they can't find my paperwork. On 5/19/10, I contacted their attorneys again to reach some kind of reasonable settlement. Instead of trying to settle the account even knowing that my permanent disability makes this case judgment proof, they refused.
They intended to pirate my bank account knowing fully well that I receive disability checks as my only source of income. Also, until last week, they continued to call and harass me even after I wrote them a letter demanding they stop calling me and only contact me by mail. I am very angry and frustrated to the point that it is seriously affecting my health. They wont let me use the credit protection I paid for, yet they continue to charge me for it. Charging interest upon interest and it is my understanding they will continue to do so until infinity, though the account is a write off. They make it impossible to pay it off.

Capital One is raising rates now in 2010, after the new law is in effect; and it based it on the fact that they sent out a supposed letter way before the new law went into effect. They said the letter was sent out in 2009. I cannot see how they can raise a rate on a prior balance under the new law this late into 2010 after the law is in effect. The supposed letter they sent should be null and void by the new law. It seems they are trying to create their own personal little loophole. And they are apparently doing it to a lot of people as I see in forums.
It looks like they are doing it a lot to people, just after they transfer a balance to Capital One at a low-rate offer sent in the mail. If you accept the offer, the transfer will be at a low rate, but your prior balance interest rate will go up, which makes the transfer rate of no use.

I finally got an answer that when they received the list of bankruptcy, there was the wrong social security number on it, which happened to be mine. I explained I never filed for bankruptcy and I needed this to be taken off my credit report and to be cleared up. I fell victim to a fraud/scam using my Capital one card in the amount of over $15,000.00. Part of the scam was to have me sign paperwork authorizing the $15,000 payment. The companies that did this were shut down by the Attorney General of AZ in April of this year, property and cash were confiscated, and perpetrators jailed. This was a verified scam operation. Capital One would not help recover the monies as they have a different definition of fraud than what the card association uses: "Any situation to where a card member has made a purchase due to information which was intentionally misleading or deceptive."
Capital One says that since I agreed to the withdrawal by these scam artists, there was no fraud committed. I never received any services or money from MRS, and the advertising campaign I paid for that these companies had supposedly ran which was never done, and the company was shutdown before the campaign could be finished, if done anyway. The form I signed, agreeing to the withdrawal of the money, was obviously part of the scam operation and not legitimate, but Cap One is still holding me responsible for the amount, instead of going after these crooks.
Cap One has created a huge loophole in the system for scam artists to operate as in what has happened in this case. If Cap One follows the card association rules and regulations, then they are in violation of what the association defines as fraud. This is definitely a fraud claim that Cap One is trying to shirk even though they have the resources and proof I can supply to do so.

Capital One charged me late fees and over limit fees for over 2 years, before I even knew I owed them money still. And at that time, I was contacted by a collection company for repayment. As a good customer to Capital One and a regular payer, I made my last payment to them in 2005. At that time, I had paid them off full.
My husband builds power plants, and we move every few years. When we moved from Iowa, as usual, I forwarded all of our mail through the post office. At our new location in Minnesota, we received all of our mail, at least I thought we did. After being at that location for just one year, we had to go to the next job location in Missouri. So again, we moved to the new state, and as usual, I forwarded all of our mail through the post office. And again, I received all of our mail as usual.
After being in Missouri for over a year, I received a letter from a collection company stating I owe them over $1,100 for the Capital One account that I believed was paid off years before.
Now, it is 2010, and I am still being called about this account. As I live in Missouri now, the statute of limitations on credit card debt is 5 years. But the rep who called me told me it is 10 years. I did not argue. I just told that person that I do not owe this amount of money, as my credit limit on that card was only $500. How is Capital One able to continue to asses late fees and then over limit fees until they get to an account that is now over $1000?
I don't know what to do, and I do not think it is fair that they can charge me so much money for something I feel I paid off in full. And after 2 years of not hearing from them, I got a letter in the mail stating I owe them over $1,100.
Now, a new collection company just purchased this from the last company that I guess owned it and tried to get me to agree to a settlement of $695 and then to pay it off over the next 7 months of $100, a month until paid off. I said no. I do not owe that money, so I am there for not paying anything. The rep then threatened to sue me. I just asked them for their fax number and told them I am going to send them a letter regarding this account. I am going to send them a letter. I found there are debt sample letters that can be used, and there are many to choose from.
Is this legal? Can a credit card company charge a consumer without their knowledge for so many months and years? What to do?

I've had a Capital One credit card for years and paid off the balance of several thousand dollars each month. In December, I received an "access check" that billed itself as interest free for 12 months with an upfront 2% fee. Instead of taking money out of an investment account, I used the access check and paid the 2% fee. Beginning in January, even though I paid off all purchases, I was billed an interest charge. I called the company and the charge was removed for January. February, March and April resulted in the same charges. I called again and was told the charge would be removed. It was not, and this month I was told the "grace" period, whatever that is, on purchases had expired with the use of the access check. Even though there were no purchases on this month's bill, I received another interest charge. I guess this is just another credit card scam. Evidently, the fees they received from the merchants for my charges each month was not enough. I spent two hours on the phone at three different times trying to resolve this problem. I was also billed interest charges of almost $200.

I called them when I was able to make a payment, in which my minimum payment was up to about $160. I told them that I had $90 I could afford to give them. I asked if I would be able to do an automatic debit out of my checking account for about $30 a month in hopes of clearing up the debt I had with them. My mother got a Capital One card about five years ago. At the time, she was healthy and working in addition to being on Social Security. She paid her bill on time every month until nine months ago.
Eighteen months ago, she was diagnosed with kidney cancer and given 6-18 months to live. Except when she took an eight-week leave of absence from work to have a kidney removed--she continued working until January of 2010 when she was in the hospital for pneumonia, ketoacidosis and a multitude of other issues. The retail store she worked for couldn't hold her position for the six weeks she would be out and she wasn't eligible for another medical leave (one per year is their policy). So her income was cut to an $800 per month Social Security benefit. In the meantime, her expenses increased with additional medications and co-payments trying to deal with her illness.
At my recommendation, she had contacted Capital One back in August of 2009 and told them she was terminally ill and having problems paying the bill. They were easy to deal with and told her to pay what she could, when she could. Five months later, she started getting calls from the recovery department. She was in the hospital and in ICU when the calls started so I called them and explained what was going on medically and financially.
The recovery department warned me that if the account was written off, it would be derogatory on my mom's credit and I told them that it was fine, do what they needed to do to her credit but write the account off and please stop calling her. She had no money, she had no job and her income didn't cover her living expenses and medical treatments. All is good, they'll do that and not call again.
Until last month, no one called. In April of 2010, she started getting calls again from Capital One now calling themselves 1st Source Advantage and acting like a collection agency. She referred them to me. Now, my mom's condition is grave. Her hospice nurse is telling me that it's days or weeks, not months, and that she could go to sleep and not wake up. She doesn't need this ** over a lousy $2,000 bill that was written off months ago.
So I called 1st Source/Capital One this past weekend. I spoke to a woman who was at best vile. I tried to explain the situation. I told her that my mom was dying of cancer and that Capital One had agreed to write off the bill. She replied, "My brother is 21 and has cancer but he pays his bills. I think that a 21-year old with cancer is far worse than your mother and she is a deadbeat." I almost fell out of my chair, I should have stopped there and hung up or asked for a supervisor but I was too shocked that someone would actually say this to me.
I told her that my mother would not be paying this bill and to please contact the recovery department at Capital One for more information. She replied, "My client will get their money. Does she have a life insurance policy? If so, you had best make other arrangements because we will take it." I have since called back and spoken to several supervisors who claim that they will take care of this woman and her attitude. I certainly hope they do. It's unbelievable to me that with so many people out of work in this country, that Capital One would allow someone with this sort of attitude to represent them.

First let me say that I have had my Capital One card for 15 years. It’s the only credit card that I have kept until now. My interest rate was fixed at 10.9% most of this time and when I paid it off it went down to 0.9%. My husband and I built a new house and our builder stole a lot of the construction money. Needless to say, we had lots of paperwork involved with the house and legal battles. We had to use our Capital One credit card to help with expenses. In paying my normal monthly bill to Capital One I asked them to apply an over-payment towards three months of payments. They did not do this and consequently raised my interest rate to 29.9%.
I called over and over to discuss but they would not lower my interest rate. Finally, one account supervisor said that they would lower the APR and I would receive confirmation by mail. I never received that mailing. Of course, Capital One denies making that statement. Just recently, I settled with Capital One verbally (for the full amount minus the interest accrued at 29.9% and an R5 rating.) The agreement was to have my money to them by April 8th or my account would charge-off with an R9 rating.
So I sent the payment ($11,267.00) on April 5th via UPS overnight delivery on the 6th with signature required. It went to their corporate office. Capital One said that they did not get it until April 12th. I sent proof of delivery. They came back with a letter stating that it was not sent to the proper department so they would not honor the agreement. They have reported an R9 rating to the credit bureaus. I sent e-mails to the CEO keeping him in the loop as it was impossible to get in touch with the contact person assigned to my case. And the receptionist could not provide me with information on this person as I was told he was not on their personnel list. I called again at another time and got the same response. Capital One does not want to help people and it starts at the top. Employees would not lie unless they knew it was acceptable by their company. I encourage people to report problems in dealing with this company. They need to be held accountable. I have had exceptional credit ratings my entire life until this situation with Capital One. Capital One has a 15-year relationship with me and they just wrote it off as if they couldn't care less.

He proceeded to tell me that they were going to lower the limit and blah blah. So I told him, "You listen here, I won't pay another penny on this card if you don't refund all of these charges." I then said, "I really don't care and you re not going to beat me while I'm down!" Well, it worked and by the time I was done, my balance was $5,450 and the interest rate went from 15% to 11%. This company has no compassion let alone adherence to the law. My father had a credit card and has since passed away. In order to help him, I had to buy his food, and other supplies as he was incapacitated and was very shaky. He found it difficult to sign his name. Unbeknown to me, I signed an undisclosed adhesion contract as a second signing authority so that I could keep him alive. At that time there was no need for a power of attorney as he was fully capable of making decisions. He was just not able to sign or drive so that I had to do everything in those matters. I am now responsible for paying for the debt. It is like paying for a dead man. I am on a fixed income and I thought that debts were discharged upon a person’s debt. This is not so according to Capital One.
I tried to explain the situation to Capital One but there is no compassion there. I suppose that they wanted me to let the man go without meds or starve to death. They put the matter into collection with a law firm and all they wanted to do was to threaten me. I have copies of the threatening letters. Since I told them that I would seek some type of remedy to the situation, Capital One has instructed the law firm to go ahead and collect the full amount. So, the lawyers as instructed by Capital One have put a lien on my property, even though I have asked repeatedly to come to a meeting of the minds, so that I would have food on the table and try to pay this debt as best as I can. I do pay my debts. I am not a dishonest person.
I still think that they are unfair, but I am willing to negotiate. I do wish remedy. Interesting sidelight...another credit card that my dad had was discharged even though I had signing ability on that one too. Is this some type of policy that this company has? No caring or compassion? I am going to send them some money and it is all I have, to start to pay them back. I am trying to stay in honor. All of last year, I worked with a reduced wage -$1600 per month. Towards the end of the year, I was unable to meet all my financial responsibilities. I found new employment that would raise my salary substantially last November. Unfortunately my new job pay period is every two weeks and receiving the check on the third week. As luck would have it, I had to wait three weeks for my first paycheck. January brought a call for jury service. I lost two weeks of pay for this. I have, as of last month caught up on my house, which was $3,000 behind. I have come current on all other payments and have returned to making regular monthly payments.
My Capital One card though is $397 behind. I made a $75 payment last month and a $100 payment already this month (which is due on the 18th). I received my statement today which reflects $39 interest charge for last month (I understand that) and a $39 late fee due to the fact that I can not come up with the total past due amount. I called Capital One to inquire. I will need to continue paying this past due fee until all past due payments are made. Now if you do the math, my $75 payment last month was $3 short of breaking even. My $100 payment, only $22 is going to past due. How many months will need to pass before I can get this $39 dropped? This company does not want to help me get current because it will cost them $39 a month. Is there any help? Calling them didn't help.

After I did that Capital One lowered my available credit. Now, there isn't enough to pay for the truck. I think that was pretty rotten and wish there was something I could do about it. But they won't help at all. I can't afford to rent the truck to move my deceased mothers furniture.

I have evidence of Capital One clearly violating several FTC laws as well Consumer Protection laws. From withholding mail so it's deliberately late so they can charge late fees to delaying or denying receiving an electronic payment, so it's late so they can charge late fees and therefore raise interest rates and over the limit fees. All this is illegal and I am prosecuting them. They also violated how they are able to collect money. They are not to contact family members or friends and tell them why they are calling. This is also illegal.
If you feel you're being taken by Capital One, if you know you've sent payments and yet they claim they never received them in time or at all, if they seem to do whatever they have to raise your interest rates to a ridiculous amount like 29% or add over the limit fees until your balance is twice what it should be, send me a letter of your complaints and let's take this giant down!! !
I have 100% confidence I will win this suit against them with the evidence I have. The Federal Courts have ordered all Attorney General's not to prosecute Capital One since Capital One suddenly (and mysteriously) became a national bank last year. So it's up to us, the AG's hands are tied. We can and will win.If you want to take them to court yourself, email me for all the documents I have proving their illegal activities so you can not only win your case and not have to pay them a dime, but make them pay you!

I noticed today while paying my bill that the APR had gone up from 9.9% to 17.9%. I have been a customer of theirs since 2001 and have never been delinquent and wondered why it had gone up. I called Capital One and was transferred 4 times. I finally got Kimberly who said she was senior account manager. Mind you, all 4 that I spoke with had the same title. I explained to all of them the interest rate had increased, they told me a letter was sent out in January to opt out and keep this 9.9% rate, which I told them I never got the letter because I would have called them, closed the account and left the APR at 9.9%.
They told me there was nothing I could do. The last person I got was Kimberly who was very rude and condescending, kept reading me the new rules set forth by Capital One. When she first came on the line, she told me she could fix my problem and that I would be the last person she would speak with. After sitting on the phone with her for 15 minutes, she finally told me there was nothing she could do since the date to opt out had already passed. When I asked to speak with her superior, she told me there was no one else I could speak with. The buck stopped with her and there was nothing else she could do, but send me a copy of the letter that was mailed out in January. If I had received that letter, I certainly would have called them, closed the account and kept that APR of 9.9%.
What these credit card companies are doing is deliberately not mailing the letters out to customers so that a customer never sees it and until the APR is increased on the bill, that's when it is noticed. When you call to dispute it, they claim it is too late. We are held hostage. The resolve that I would like is go back to my 9.9% and if I have to close the account to keep that interest rate, that's fine with me. This is highway robbery. Two other of my credit card companies did the same, but they were courteous enough to put the rate back to what it was and I closed the account.

I noticed a sudden spike in the interest-rate I was being charged by Capital One credit, and so I called their customer service line to inquire. My January 2010 statement from Capital One showed an interest-rate of 4.9%. My February 2010 statement showed no report of my interest rate. My March 2010 statement shows 15.9%.
I called Capital One’s customer service line and spoke to several individuals. I was told that despite my 11 years with Capital One and despite my excellent payment record, including as they noted early payments each month, they had made a "Business Decision" due to the current economic conditions to raise the rate. I asked for a review and for what options were available. I was told that prior to March 1, 2010, had I called them, I would have had two options; (1) Accept the 200% increase in interest rate or (2) Return to my previous rate of 4.9%, but then my card would have been canceled.
Again, note that I received nothing on my February statement from Capital One regarding any interest whatsoever. There is no interest rate on the statement. Unfortunately, I was told that since I did not take the OPTION 1 prior to March 2010, there is nothing they could do. They said that in effect, my not reacting to them in February 2010, I "ACCEPTED" the increase. I was astounded! They told me what a great customer I was and that they were thankful for the 11 years of loyalty, but there is nothing they could do, it was a "Business Decision".

I'm in a financial mess. As anyone else who's been doing their homework, I figured if I call Capital One, they may lower my interest rate. I've been with this company for 7 years, and never, ever paid late. I explained my situation and I'm told there's nothing they can do. I asked nicely, never yelled, never accused, and explained I only need it temporarily for 3 to 6 months. I'm refused by both the rep and the supervisor. Capital One seems to route their calls to India. Both reps I spoke with are Hindu.
By the way, I tried Chase, Bank of America, and even my local credit union, and none of them would offer to lower my APR. In fact, they all told me they couldn't. Bank of America was the only one that would lower the APR but that's from the high 10s/20s down to 10%. Luckily, Bank of America only charged me 6.24% APR and the rep explained she couldn't go any lower. I understood that and respected they had at least that program to help. But every little % helps. Citibank was the only company that when I called I didn't have to ask to speak to a supervisor.
The rep told me since I've been a valued member (7+ years too), she would look into it when my promotional APR of 1.9% went away and 29.99% kicked in, which is just in a few months. I asked if I should call in, but she promised me she would look into it personally and not to worry. In fact, a few years ago I called Citi and mistakenly thought my balance transfer was supposed to be for a longer time period, and the supervisor gave me a 0% interest rate for 1 year without me even asking for it. Citi has been the best.
Bank of America seems to have a way to help you, and the rest doesn't care about their customers. I've never paid anything late in my whole life and my credit score is in the low 700s. There's no reason for them to treat me like dirt. I'm closing out the other cards except for Citi and BofA when I pay off the debt. They don't deserve my money. Leave bad credit card companies that don't care about you and move to a company that does care about their customers.

When I called them, they told me it was my fault. I should've contacted them earlier. I spoke to a supervisor who took absolutely no responsibility for Cap One's error and left it at that.
They were not getting any returned mail which would indicate whoever they were sending the statements to was not kind enough to send it back and not to mention they now had my acct info. Due to me not receiving statements on their error, I started getting delinquent notices which I couldn't pay due to the months of not getting statements. I could no longer make payments and I was taken to court by them and now have them deducting from my paycheck. I feel this originally started due to a mistake by them and someone should have offered to compensate me for such.

I have had the capital one Visa card ending in 1269 doing some publishing and business from home. My life was turned around when loss of job happened, business from home did not pick up, the bank took over the rental home we had, we had to move, etc. It's been taking a long time to recover after we were working hard to get back up on our feet. In the meantime, we fell behind on bills and ended up in the "survival mode" of basic necessities. Many times, I have been working back and forth with capital one on payments, waiving fees etc. The last time I spoke to them via phone, they had said because of hardship they would not do any charges for 3 - 6 months. It was too good to be true, but I honestly thought they would want to help us in our time of hardship.
Eventually, from all the stress of life, I ended up not well during summer till fall 2009 and any extra bills that came in besides basic rent and food, we rarely opened because of the frustration of knowing we could not pay them as of yet. With all the loss we had already and had to medically get treatment for new symptoms. I am doing better and have to manage whatever I have to deal with.
In the meantime, the latest thing is that Capital One did not keep their verbal promise. My card limit is $500, but I am getting statements now ,saying I owe $1,153.54. I am appalled by these charges. To me it is fraudulent charges. It is like someone stealing my credit card and charging on it. The problem is, if I was to charge it, lets say for food and gas we needed, we would not be able to charge it. It would be denied. But it is okay for the company itself to charge on my card their fees when I have a limited amount? So, it is okay for them to cheat me?
Not only that, the collection agency they had was extremely unethical. At first, they are calling saying they want to work it out and bring down the payment and the interest of 29%. They want to bring it down to about $900. I said, no I can agree on six. Then, they tell me that they will promise (again verbally) to make a payment plan with me, if I pay "today" by phone using a checking account (which I closed before), or send Western Union (which I can't afford to pay that extra fee). Then, they will send me something in writing with the payment plan. When I said I don't have a checking account to provide, they suggested if I can use someone else's checking account that I knew. What kind of plan is that? This was with John from this collection place. It's suppose to be Allied Interstate but they leave another company name when they call.
Today was even more interesting. I spoke to a lady who transferred me to the supervisor Tod. As I was speaking to him, I firmly explained to him that I want the plan in writing first and then we can talk. And that it has to go down to six hundred dollars. I explained that Capital One did not keep their word and I do not trust anyone. So, what do you think he says; He laughs and says; "did they put it in writing?" I said, it was a verbal agreement. He said, that don't count. So, I said, "There you go, that is why your verbal agreement don't count either"... You think? He wants to do a verbal agreement and he just told me I should get it in writing. What a smart fellow. I said, "Thank you" and hung up, in between him saying, I will call you everyday! He can call all he wants, does not mean I have to answer the call!
I really thought that Capital One business was trying to work with me. I am highly disappointed that they treat people trying to publish or do any business from home, losing almost all their clothes off their backs in the manner that they are doing. I am appalled by this.
I am looking at other alternatives, even seeking bankruptcy at this point, again. Although I rather not. That is an extreme case.
This is causing my family more stress and making my medical condition more challenging at this time. I would love them either to bring it down to $600 and I deal directly with Capital One or for them to write it off as a loss. Otherwise, I don't plan to work with them at all!

I had two accounts with Capital One. They did the same thing to me that I see they've done to others. When I did an electronic payment, it wouldn't get posted that day or the next, but a week later after the due date. Then I'd get hit with a 29 late fee. This didn't happen just once or twice, but almost every time. I became cautious and printed the receipt they gave me that had a confirmation number on it each time and sent them a copy of my proof of payment. But they said the receipt was irrelevant.
So I stopped paying electronically and began sending a check via mail. I made sure to send it weeks in advance so it would have plenty of time to get there and be processed. Once again, they would hold onto my payment until after the due date and charge me late fees. Then they jacked up my interest rate on both cards saying how I had been late, which pushed me over the limit and then I was hit with almost 100 dollars of fees and they also increased my amount due dramatically.
I found out through the FTC this is in clear violation of the FGBA and EFTA, which states that they must "credit all payments to your account on the date they're received.” There have been so many complaints against Capital One, that the Attorney General in WV sued them in January of 2010 and won. I am starting the process of a class action lawsuit against Capital One for any customers in the Massachusetts area. Please send me your complaints and I'll keep them on file and keep you notified.

I contacted Capital One today to see if they could lower my interest rate. I, like many people in this country, am dealing with a spouse whom has been out of work since April of last year. When I opened the Capital One card in March of last year, I had 0% interest for balance transfers. I took advantage of it, paid what I could on time every month. In March of this year, the promotion was over and my interest rate increased to 14.9%! Needless to say, I can no longer handle the $180 payments, even though I paid last month and this month on time. I called to see if they could lower my interest rate because I want to pay this debt off.
I do not want to ruin my credit and become late on any of my accounts if I do not have to. Ozzie informed me that he could do nothing because due to the economic downturn, most Capital One consumers are paying 17.9% and typically they would be lowered to the 14.9% if they asked. I then asked Ozzie, "So you are telling me that there are no other customers paying less than 14.9%?"
He told me that there were, but he could not lower my account to those rates. I basically begged him to help me out and wondered why the company would prefer to have a customer not pay versus have them pay less? He just kept saying there was nothing he could do, so I asked to speak to his superior, and then he insisted that she would say the same thing. I argued with him for several minutes as to why I couldn't speak with her, asked for his name, and he gave me his agent number so I could file a complaint.
He put me on hold for 5 minutes to get me the "number" of general correspondence, only to come back with an address that I had already found online. I again asked to speak to his supervisor and finally he agreed to let me speak to her. I plead my case, explaining that it's all over the media that credit companies are willing to work with you if you call before you run into problems and yet here I am, doing the exact thing, and they can't do anything for me. I thanked her for nothing and hung up! I am at my wits end and sinking fast. I am so irritated and outraged that I could cry!

It is only 1 day before the court date that I just received their letter which did not give me time to respond via mail. I was surprised they didn’t mail it sooner as I see it was written April 14th. I am writing to let them know that not only will I be disputing their claim, but I am looking into a counter lawsuit into the illegal and deceptive practices of Capital One.
Upon looking into my records, I forgot about all the problems I had with Capital One which I have brought to the Attorney General’s and Better Business Bureau’s attention. They seem to be the exact same problems that thousands of other customers have had with Capital One. So many complaints have been filed against Capital One that the Attorney General in Virginia, where Capital One’s headquarters are, filed suit against them for illegal and deceptive practices and won. I have asked for his assistance in doing likewise.
To start, Capital One would not acknowledge receipt of payments made until they were past their due date so they could charge late fees. If I paid electronically and got a confirmation number and printed the receipt out, they still said they had no record of the payment being made and the confirmation number and printed receipt meant nothing. I found out they did this to thousands of customers. If I sent a check in, even if I sent it in weeks in advance, they wouldn’t post the check until after the due date, again, to be able to charge late fees and then jacked up the interest rate to 30%.
When my credit card was being used illegally raking up charges in states I’ve never been, I called them and they said I would not be held accountable for the charges and they would reissue me a new card. They never did. They left the unauthorized charges on my account with steep over-the-limit fees since they jacked my payments up 75%, and no matter what I paid, it never went towards the balance, only towards over the limit and late fees. It spiraled from there. The last bill I saw was for $3,500, which was $500 over the limit. They now say it’s at $4,479.73, that’s over $1,500 of their fees they’ve added, not to mention the $1,500 charged illegally to my card. I’m sure by next year they’ll claim I owe them $6,000.
I have recently had surgery, out of work, and about to be homeless. If this total amount was all mine, which if no wrongdoing on Capital One’s behalf, I would be glad to make some sort of payment arrangement although at this time I can pay nothing. Capital One did illegal and deceptive things and I intend to fight it in court. I want it to go on record how crooked they are.

I contacted Capital One and was told to contact Credit Inform directly even though Credit Inform is owned and operated by Capital One. Today, I telephoned Credit Inform. I asked who authorized the implementation of their "service". I was informed that I had authorized the service when contacted by phone. Their representative asked for my phone number to look up my account. I provided the number and was informed that the number did not exist. I provided a secondary number and was once again informed that the number did not exist. Obviously, they didn't have my number.
I provided my SS number, which immediately accessed my account. I stipulated I wished to cancel the service which had never been requested. The representative began spouting the praises and purposes of the service. I once again stipulated that I wished to cancel and would like my card to be credited for the unauthorized charges. He told me the service would be canceled immediately. I asked about a refund and was told that they have sent out a quarterly report that should arrive shortly and I was paying for that service. What service? I didn't ask for any service, no one ever spoke to me. I was then told that I had authorized the service when I opened the credit card. I have had this card for years and the charges just began appearing so we know that is impossible.
I asked how many other stories and excuses there are for having charged my account without authorization after which he told me that a credit would be processed and should appear on my account within 2 months. For now, I will have to take a wait and see attitude. This was not the first time something affiliated with Capital One appeared as a charge on my account without my authorization. How is it that a company can continue to get away with what I consider consumer fraud? They always cancel the services or subscriptions and refund the charges due to my persistence. I am sure there are many people who have been falsely charged and have no idea how to deal with the situation.

So I faxed in 6 pages of bank statements, driver's license and paycheck stub. I called them again to see if my paper work had been looked at, they guy said that they had not, but if the information matches what I put on my application then I should be fine but to call back in two more days to see what decision has been made.
seriously as a first time credit card user I am not used to this anti-fraud stuff, but putting an account on hold for two payments made back to back is a little ridiculous. I went in to the Flower Mound Branch of Capital One to deposit a pair of checks, one of which was for my mentally and physically disabled father-in-law for whom I am attorney. In fact, I have durable power of attorney. Despite the account being used for this purpose for almost a year with many checks including ones just like this (Treasury Dept.), I was informed this wasn't sufficient any longer and I needed to reopen the account correctly. I have no idea how the account was opened incorrectly but Lynn, the Assistant Branch manager, said it was wrong and therefore we could not deposit the check. This was after her asking me to sit in her office for over twenty minutes waiting on something that usually takes minutes and we handle through the drive through.
I then stood up to leave and Lynn took the check from her desk, and despite me asking her for it, since she wasn't going to do anything with it anyways, she refused and I reached over and took it from her hand since after all, it was my property and she refused to give it to me. She then very dramatically claimed I assaulted her and called the police. The police have already informed her and me that no assault took place, especially since it was my property in question nor was there any bodily harm on her part. However, the branch manager took it upon herself to freeze all my accounts, including the business account for the company for which I work, which is also the account payroll and benefits are drawn against.
No notification was given as required by law and they refused to speak to me, despite the fact that they have to in order to close the accounts, which they claim they want to do. So in the end, nothing criminal is happening despite Lynn's best efforts to the contrary. My accounts are frozen, including my employer's account which isn't even under my social security number and they won't speak to me to resolve the issue or even let me close the account. This is a violation of Federal and state laws governing banking and availability of funds, as well as a breach of contract between my company, myself and the Capital One.

Then I visited the Manager who contacted the Richmond, VA Post office and was told that Capital One's courier often held delivery of payments unnecessarily longer until the were posted at the lock-box late.
I called the Washington Customer Service of the USPS and was told to report this information to the Postal Inspector's office in DC and I was asked to complete an incident report and be prepared to send copies of any incriminating evidence. Meanwhile, I spoke with P.O. Sheila D. at Boston's Police Headquarters and had no further contact. From then I paid more promptly until I was forced by health circumstances to obtain a Chapter 7 bankruptcy award.

I tried to close my credit card acct. mid 2009 ,but until it is paid off you can't close the card down, even if you will never use their card. They charged me a membership fee of $59. They told me that fee is for sending out statements in the mail, use of the online service and more. They would not reverse the charge and will charge me again.
The call center rep. agreed that it was unfair, but could not do anything about it. I thought you could not charge a fee for online payments. They believe the law cannot touch them. I would love to see them go under and those put in prison. They have inside people at the White House and nothing will happen to them. Down with Capital One and no one should ever think about using their service.

I just got off the phone with customer service after learning my interest rate increased from 9.98% to 17.9% and I'm extremely upset. I have had this account for a very long time and always paid it on time. This is an outrage! It was also quite a sneaky thing to raise my limit by $4000 one month before this happened. Now I'm very glad I didn't use much of that increase.
This is some of worst business practice I have ever encountered and the kind that bring about lawsuits. I informed the customer service rep that if this was not rectified, I can and will pay off and close this account. She had no options to lower my rate so I will be closing my account this week. After such long standing good account activity, I can't believe Capital One would treat me like this. Credit card companies think they can do whatever they want as they say "or you can pay off and close the account" knowing full well 99% of the card holders can't possibly do that. Word of mouth can go a long way and I'll be spreading this poor customer treatment as long and far as I can.

I have had two loans with Capital One starting in 1997, both of which were paid off early. I have had excellent credit and in 2005 I took a third loan with Capital One for $32,000 for 60 months at $500 a month. Last year (2009) I was going to be taking a cutback in hours and my wife was not going to be getting a yearly raise. I called Capital One at the end of May 2009 and asked to refinance this loan ($23,000) and their credit card ($6,000) into one new loan and let me take the max term they offered 84 months, which would cut my payment in half.
I was told how awesome of a customer I was and they appreciated my business, but they cannot refinance the loan or combine the card with the loan. In order to keep my excellent credit rating, my wife and I cashed in 401K and even our daughter's college fund and finally at the end of last year the money ran out. I even tried working with Consumer Credit Counseling, but they told me Capital One does not work with them or allow them to set up payment plans. Finally I just stopped paying them in January of this year at the advice of an attorney.
I have found out that the reason they would not refinance last year to help me out is because they own their own in house recovery unit that likes to refinance Capital One debt at twice the rate and fees so that they make more money on the second chance program than if they would have refinanced me last year when my credit was perfect. Every letter I sent last year and every person I spoke with told me what a great customer I was and they were sorry there was nothing they could do. I hate to see how they treat bad customers. Until this event I have never missed or been late or ever had bad credit and now thanks to what I consider unethical and immoral behavior my credit is shot and if I do make arrangements with them I will be paying them double what I owe them. What a disgrace.

When you setup a new Capital One Money Market account, there is a question that asks if you are subject to Fed Tax withholding and if yes, you check a box. I have never checked the box, but now for the 3rd time on 3 different accounts, they have withheld fed tax. On one account, the only way I could resolve the problem was to close the account.
I was told that I had to write a letter and ask to have the tax withholding stopped, I did that twice and they did not stop it. I was finally told by a CSR that the only way they could think of to stop it was to cancel the account and open a new one so I did. The next account that it happened on, I was able to get a CSR to stop future tax withholding but not until after tax was withheld. Now on another new account, they have done it again. I keep copies of the application forms so I can prove I never checked the box.
At first, I just thought they were screwing up, but now after a 3rd occurrence, I think it is a plan. I think what they are doing is withholding tax on your account balance, and then they apply the interest to the lower balance. If anyone questions it, they say oops, sorry about that and maybe fix it for you but in the meantime they have used your money, and then withheld tax that you didn't ask to be withheld so that they are paying interest on a smaller balance.
For most of the accounts the amount withheld is probably small, in my current case, $2.32, nothing huge, more of a nuisance, but if this is intentional and they reducing account balances by withholding fed tax, then paying interest on the adjusted balances, they are saving huge amounts of interest payments to their customers. Does this sound plausible, is anyone else having this trouble?

Capital One credit cards made an unauthorized electronic check withdrawal from my account in the amount of $642.00. It has now taken 11 days and three conference calls with Capitol One and Bank of America. Every time I call back, account managers state that they have no record of speaking with my bank. I had the bank fax confirmation that a double payment was withdrawn and the account manager reports that it does not have any report of that. They state that they have no superiors that I can speak with and, as of this date, it is still unresolved.
Each manager I speak with advises me that the money will be returned within 48 hours. I have kept records of every manager I have spoken with. I had $150.00 in overdraft fees as a result of the extra withdrawal or bounced checks. I also have a payment due for my son's admission fees in the amount of $900.00 that I cannot pay as a result of Capitol One not returning the money and restricting access to my credit card.

After the 25 days had long passed, I contacted Capitol One by phone, email, fax, and mail.
Each time I was told to wait until midnight for the system to update my account. The payment was made on Feb 5, 2010 and as it stands now, I never received any response from Capitol One even though I provided them a copy of the agreement. Not a month after I transferred the balances, Capital One raised my interest rate to 17.99% (now the highest APR of any of my cards). I called Capital One and after being told I "misunderstood" the offer, I was transferred to an account manager. Although the account manager was nice and pretended to be understanding, she stated there is nothing she can do. Everyone I spoke with confirmed that my rate was 8.9% when the balances were transferred to Capital One, yet they blame the economy for raising my interest rate weeks after the transfer.
This is completely shady and unethical business practice. They did not care that I have excellent credit and have always paid my bill on time. In fact, it is my belief that this may have caused the interest rate hike. They suck you in with empty promises and if you have a good payment history, they milk you because they know you'll pay! I was a good customer for years and this is how they repay me, waiting for me to get a good balance on there and then doubling my interest rate. I have a few other credit cards, and none of them have raised my interest rate more than 1%-2% due to the bad economy. Please have your lawyers consider a class action suit against Capital One. I have been a member of the Capital One Banking system since its acquisition of Hibernia National Bank. Before Hibernia National Bank, in my city, this banking system was called Texarkana National Bank. Needless to say, I have been a member of this banking system for approximately the past 20 years. I have a problem with the way this banking system regards its long time customers. In essence, I feel that this banking system gives no regards to the longevity of its customers or to the frequency of transactions through its banking system.
For the past several years, I have been charged outrageous overdraft fees on dollar amounts as small as $4-5 dollars. To be charged a $35 overdraft fee, for a transaction of $4-5 dollars is consumer robbery! I have applied for a line of credit through Capital One, for as little as $300 to help cover any overdraft fees that I may occasionally have, but was denied this small line of credit even though they "offered" it to me. I have been made aware that there is a problem with various banking systems in regards to the "excessive" overdraft fees they are charging its customers. If there is any information out there regarding these fees and the Capital One banking system, I would appreciate the information.
It is with sadden regret that I am currently decreasing the amount of money I have directly deposited to Capital One on a bi-weekly basis. I am also cancelling the majority of my bills which are paid through its bill pay service (another rip off), which is only another means to charge an overdraft fee, and is causing me an overdraft in my account on a bi-weekly pay period. I currently have two Capital One credit cards with no balances. I am also cancelling these cards. I have had these two cards for several years, each with a $300 credit limit. I have not had a credit limit increase, nor have I had the offer of a credit limit increase.
I paid off an auto loan in 2005 through Capital One finance, but this seems to have no bearing on my credit worthiness to this banking system.I am sure that my decision will, in no way, have any bearing on Capital One's procedures for customer longevity, and with the "millions" of individuals who are serviced through Capital One, I realize that I am the only one dissatisfied customer. In my opinion, "one" is too many! Thank you for your time in reading my complaint.
Consistent overdraft charges ranging from $200.00+ "every" pay period. This has caused me stressed in being able to pay my regular bills due to these overdraft charges being deducted each bi-weekly pay period when my pay check hits the bank. I am constantly running "short" on cash each pay period because of this, which causes me headaches and neck aches from the tension this procedure is causing.

I have not made any purchases recently with this credit card. So I do not understand why I am being charged interest on a "purchase segment" You can see on my statements that the entire balance I have is listed under "Special transaction". This was a "0%" promotional offer from sometime in 2009. I emailed customer service in 12/09 to ask when this promotional rate would expire and you can see the response was that it expires May 24th 2010. Since I haven't purchased anything or added anything to this account, I really don't understand why I am being charged any interest at all before May 24th. I would appreciate if yoyu could clarify this for me, or better yet correct this matter. If possible I prefer not to deal with the acct managers from the 800 number because they have not been able to help me and have only been rude.
"We have received your question regarding the interest charge. So that we can better assist you, we have reviewed your account and found that it is the finance charge on your purchase segment. Interest will not be assessed on new purchases if the total new balance is paid in full prior to the payment due date. If you do not pay your next bill in full a prorated interest charge will be assessed on the unpaid balance. A prorated interest charge will be assessed on the remaining balance and will be applied in your next month's billing period. If a cash advance or special transfer is made, interest will be assessed as soon as the transaction applies to your account."
I am being charged $82.18 interest on this account even though I received this email from Capital One services stating that my promotional rate expires May 24, 2010. I called customer service hoping to resolve this matter. I was transferred to Acct Mgr. "Amanda" who asked me to hold for "3-5" minutes. After holding for about 23 minutes I hung up and tried again. This time I spoke to Acct Mgr. "Jasper".
I explained that I had an email confirming the expiration of the promotional rate as May 24 2010 and that I did not see why I was being charged. He put me on hold just a few minutes and asked me when I made the transfer. I obviously don't remember the exact date and that's why I emailed Customer Service in December 09 to confirm the expiration date. I told him I had an email from Cap. One. He said, "well that email doesn't mean anything to me". I told him if he couldn't help me, he should transfer me to a supervisor. He said, "My supervisor doesn't take calls."
I asked him to transfer me to another acct mgr. He said "I can't do that, I'm not going to transfer you." So I hung up on him, called back and spoke to "Pauline". She within 5 minutes and without being rude was able to reverse the charge of $82.18 "as a courtesy" but informed me that my account is still accruing interest and would continue to do so regardless of the information given to me in the email.
I do not think this is fair. I have been in good standing with your company and I would think that if indeed there was a mistake on your end, the least youcould do is honor the expiration date of May 24th I was "mistakenly" given. I am not trying to cheat the system, I am not trying to take advantage of anything. I am only asking that the May 24th expiration I was told of be honored so that I can work out a way to pay the balance before then.
"Dear Evelyn, Your balance transfer interest rate is 0.00% non-variable. This interest rate will expire on May 24, 2010. After the expiration date, your interest rate will be your existing purchase rate. We determine the different fees and rates for each of our products depending on the services we include and the markets where we offer them. We continually review our rates to assess their competitiveness. If we determine in the future that we can offer a change, we'll let you know. "
The balance on my account is from a balance transfer I made, when does my promotional rate expire and is there a way to extend it?

After she died on 3/6/2010, I contacted Capital One and explained she was deceased and that I would pay the bill when the statement arrived. I specifically asked if the statement would be a payoff and was told yes. I paid the full amount on the statement and today received a statement that $8.24 was due in interest. I called and was told $8.24 was due and they would not give an inch.
I explained that my sister had another card, sent paperwork showing that interest stopped the day she died and the actual final bill was less than the monthly statement showed. My sister had been disabled for almost 10 years and had no estate. It was our private agreement that her bills be paid with honor since she had used the credit cards for prescription drugs when necessary. I previously filed a complaint regarding Capital One, who responded with a lie and on top of the lie, they originally told me verbally.
Last year, I transferred a balance onto my Capital One Card and was promised a 2% balance transfer rate by operator **. Upon receiving my bill, I learned that I was being charged 10.99%. When I called to advise of the mistake, I was told that I agreed to 10.99%. This was an outright Lie.
Capital One reiterated this fraud by responding to my consumer complaint saying the same thing. Recently, I refinanced my mortgage and consolidated Credit Card Department, including my Capital One Card. My intention was to get rid of this card, pay off the balance and never have to deal with them again. I, of course, continued to make all payments on the card during the refinance process. At the time of my closing out of a concern, there would be a further delay in getting the final payout to Capital One.
In March, I called and requested an extension on the payment due date to allow a window for them to receive the payoff balance. I was told over the phone, "No problem" and my due date was extended a sufficient amount of time to pay off the card. I have now received another bill with a late charge and an additional finance charge because Capital ONe did not extend my due date as I was told they would.
This company is defrauding consumers every day and getting away with it. What can be done? There was an undue charge on my card after Capital ONe agreed to extend my due date.

I purposely got this credit card for the purpose of establishing credit, so paying on time was very important to me. It also had a low introductory rate. I always made sure to allow a week and a half mailing time, since they would charge you $15 if you wanted to pay directly from a bank account (bogus practice). In January, I was informed my payment was late and would go up about 20 percent interest. I asked them to fax me a copy of the postmark; since I was totally positive it was mailed and received in time. They refused to. I then wanted to immediately close the account and pay at the original interest rate. That also was refused.
I then spent 6 months attempting to pay if off, since each time I called for the total amount owed and paid that, there was always some charge added that kept the account open. It dragged on so long they added an annual fee. I finally got irate and asked why they were not telling me the correct amount that I owed to finish it. They said that even they did not know that. Then I asked if I could pay over, just to finish it, they said they would refuse the check and charge me a late fee if it was over even a single penny.
Now, on my credit report is 2 late reports from them (not the case originally, and one for over 60 days, which is totally false). I believe the original late incident was created by them to get out of the low initial interest offer. They have also requested credit inquires 6 times in a 2 month period on me to damage my credit rating, since I am very not interested in having their credit card ever again.
I don't believe there are any checks and balances on these companies for engaging in these practices. I think people will assume you are a liar, and the company isn't. The times they were investigated, they were guilty of this and continue in these practices. It is way too easy for them to hold payments and the consumer has no protection on it. They also should be legally forced to accept direct bank payments without their high fees, to stop this holding payments game, and holding hostage your credit score.

Interest rate hike by credit card company. Received and automatic credit limit increase. Along with that increase, I received an interest increase to 29.99%, which the company justifies as it being to late payments (2 late payments to be exact) which occurred 4 to 6 months prior. So my question is directed to the company, why wasn't the interest increase implemented immediately after the second late payment?
It wasn't because of the new credit/bank laws that were to go into effect at the start of the new year, so the credit card companies have unjustly targeted cardholders with bogus increase. If I am being penalized for being late twice, why would they turnaround and reward my account with an increase of $3500.00 then raise my interest rate? When I called the card company, I was told I could request an interest rate reduction after six months. On the seventh month, I called the company and was told no, not in six months but call back after 12 months. I'm most certain I will get another story then too.

A John D. called me regarding a network marketing training program. He indicated the cost was $10,000. I indicated I did not have that kind of money. He disputed this indicating that I must have a savings account or other money/accounts of some sort to draw from. To prove it, I (stupidly) relayed my credit card number after he asked about how much credit I had available. He was very coercive so I wanted him to realize that I only had a couple of thousand dollars worth of credit available. He ran a check but also in the process charged my card to the full extent of my existing credit in the amount of $2,000. I protested stating that I had auto payments that would be coming through that would result in over limit fees.
After getting off the phone with John D., Capital One telephoned me to advise that he had attempted to charge an additional $500 to my credit card subsequent to our conversation without my knowledge. John D. told me not to worry because I'd have a $5,000 check by the end of the week that would more than cover the charge and that they would assist me to accomplish this immediately. Then he said that I should leverage earnings to meet the $10,000 fee to become an "inner circle" member. He promised an all-expense paid training session in Malibu, CA or he'd fly to my home in Minnesota to do the training. I never heard from him again.
The reality of the situation was that they basically blew me off from the beginning. Their initial scheduled phone conference with an agent was totally ignored and I finally had to call them. The agent seemed surprised and unprepared to speak with me. This was their repeated pattern which reflected a total lack of attention to any service or training commitments.
It is not about network marketing training, it is purely a money-grabbing scheme which is unlawful. The Los Angeles Police Department is actively investigating them which will result in charges against them. Needless to say, despite my numerous timely attempts to have the $2,000 charged back to IncFortune.com, which included providing Capital One with various forms of documentation, Capital One has sided with the IncFortune.com predators and refused to credit my account.
Therefore, I consider them complicit with and an accomplice to this internet marketing scam that has fleeced at least 80 to date including the elderly who literally turned over their last dime to these no good gutter snipes which has left them literally penniless. This is an admonition to beware of the Push Traffic, aka Success Rate, aka IncFortune, aka Jump Launch, etc. scam and Capital One. Don't do business with any of these people. Due to these challenging economic times, my wife and I ended seeking help through Consumer Credit Counseling Service rather than filing Chapter 7 Bankruptcy in order to honor our financial obligations. Our experience with Capital One has been absolutely horrible. Before I get into my specific issues that I have with Capital One, a little background information is in order.
When we first contacted a CCCS company, we knew that there would be some timing issues regarding the proposals to our creditors and reaching mutually acceptable agreements for repayment of the debts that are owed them. Initially, the first proposal to Capital One was declined because the proposed payment amount was too low by approximately $3.00. I was contacted by the CCCS company and was told of Capital One's rejection of the initial proposal and the counter-proposal that Capital One had offered. I immediately agreed to Capital One's terms. The CCCS corresponded back to Capital One stating our acceptance of their counter-proposal.
My problems with Capital One are:
1. One hand doesn't know what the other hand is doing (departments at Capital One don't communicate with one another).
2. Each time I am contacted by a representative from the Capital One collection department, I get someone from India who speaks very poor English, rude, hangs up on me and refuses to let me speak with a supervisor (most of the time) when I ask to speak with one even though I am polite and respectful towards them. When I do get to speak to a supervisor, I am passed off to someone who seems to put the phone down when I am voicing my complaints.
In my humble opinion, Capital One has become one of the many scourges of the financial industry. It is my intention to blog excessively; file complaints with as many regulatory agencies as possible with regards to just what I have experienced with Capital One.
3. Capital One has already agreed to the revised debt repayment proposal yet they constantly call and harass me. I am getting calls even after it is legally permissible to call (have had calls at nearly 12:00 A.M. and before 8:00 A.M. as well).

I had dealt with the same problem on Nov. of 2009 and I was credited for the amount of $20.00 that I caught missing from my checking account. After the November issue, I noticed money missing, but I made no complaint because I feared to be confronted with a problem. On the 18th, I called customer service regarding the $10 issue and spoke to Sara a representative and she told me that she spoke with the manager and that I would be credited.
The day after when I went to inquire and spoke to a Hispanic staff at the Pelham branch, the staff went over to the manager and the manager with a tone told me that she was going to close my account because I'm always complaining about my balances every day. I simply replied about what Sara and I had spoken and told her I would call again to Customer Service. When I spoke to customer service, I was told that the manager was not closing my account but if I caused a scene, she would close it.
This upset me because I had perceived her as a person with racial issues. For example, if I treated myself to coffee as the bank offers as a hospitality to customers, she would come charging at me to tell me not to take coffee because it was for customers waiting to be called. Anyway, I went over to the bank and disputed with her about her comment with customer services regarding a scene and she closed my account.
This dispute caused me to get arrested and see a judge at criminal court. She called the cops and lied and told them that I have a gun and that I wanted to shoot them all. I received a notice that I was going to be charged a $59 yearly fee, unless I called to cancel my account. I called to cancel my account to avoid the $59 yearly fee, but was told that if I didn't pay the balance of $4000 off on my card in 90 days, I would be charged the $59 fee anyway. The money owed to Capital One is on a balance transfer of 3.99% for the life of the loan, which I paid a nominal fee to get. Now, they are are breaking the terms of this agreement by forcing me to pay $59 whether I have closed my account or not.

During 2009, I was charged several late fees due to mail delivery (It was corrected each time), and of course, this cannot be confirmed. I always mailed my payment at least a week in advance. Secondly, this month of April 2010, they took out a fee without notice, and charged me a late fee when I used the card with money confirmed on the phone the same day, and then said that the shop where I've shopped for more than 3 years was late in presenting their payment. How am I responsible for that?
But ,they charged me another late fee. Every month it is something else. Are they trying to ruin my credit? When I paid online, they swore they didn't get the payment; I paid by mail; the mail was late. I wonder, do they let the payments just sit there in the office until they figure out a way to take my money? I cut up my card today, April 6, 2010 and when I requested a statement for the last three months, they hesitated. and said each sheet would cost me $3. And, if I cancel, that I will incur more fees for that decision and new fees will be assessed until I pay off the balance, a balance they cannot verify immediately by fax. I can't imagine what fees they can assess against a closed account.

I received an offer from Capital One for a card with a promotional 0% interest rate for a year. I applied for and received the card. We used it to pay for some car repairs and got it paid off within two months of making the charge. When I paid it off, it took two weeks for my available credit to reflect the payment. Then, I contacted them to find out if I was eligible for balance transfers, and if I was, what the interest rate was. I was told I was eligible and that my interest rate for balance transfers would be the promotional 0% through March 2011.
However, when I called back a week later to actually request the transfer, I was told that the interest rate for transfers was 18.99%. I was transferred to an account manager who when I told her of my problem and the message I received from them the week before, she told me it was a mistake and that I wasn't eligible for 0% on transfers even though they told me I was. I immediately responded with asking her to close my account. This is not how you do business. I've never seen a credit card company wait 14 days to reflect your payments in your available credit. And, to go back on your word on a customer who paid the account on time and in full, well, that's just not how you do business.

I got the story of poor Capital One suffering in these economic times had to raise rates, but it has nothing to do with my credit history, or payment on the account, and how sorry they would be to loose me.
What I want to know is when our Government, (Senators and Congressmen) are going to stop protecting these companies, especially those who got bailed out by our government, but are bilking the consumer as punishment. Unless you elect to raise every single card holders interest rate, then you are committing discrimination.

A few days ago, I looked at my transactions on my credit card. I don't use it too often, so usually I just check the balance. Well, I realized that when the interest hits, I'm hit with another charge from Payment Protection. I called in about it and they refunded $50 and cancelled the account. I looked back on my statements and realized they have pulled $127.08 from my account total, so I called back and they said there is nothing they can do. $50 is all they can refund.
I asked how I was signed up for this without my authorization and they said Capital One customer service had me signed up, so I called them and end up speaking with a supervisor about closing my account. He pretended to completely take my side, acting like they did something illegal and stuff like that is why our country is in a mess, but there is nothing they can do. I'm not sure what I can do. I guess eat the $77 but it's the principle of the fact that gets to me. I was unknowingly signed up for a service that I never would have verbally agreed to, nor have I signed for. Then, when I tried to get it resolved, they still come out on top. I have my credit card on hold and am paying it off, then i'll be closing the account and going to Chase.
After the $50 refund and cancellation, which showed me they know they were in the wrong, they refused to refund the additional $77.08 that they got from me, and it really just pissed me off more than anything.

My interest was 7% on one acct and 10% on the other which I accepted; however, I was called last month and asked if I was okay with them not charging me late fee if I was ever late on my acct. They would waive the charges. Then this month when I received the bills. My interest on both accounts was hiked up to 17.99%. When I called them, they stated that due to the economy my interest had increased(?).

I have had a Capital One Credit card for quite a few years. I have always paid more than the minimum payment on this account every month. I have not used the card in over 2 years. Today, I got a call from someone who didn't even speak English, yelling at me that I was late with my payment (which is due on the 16th of April). Unbeknown to me, they had raised my minimum payment so my last month’s payment was short of the minimum payment. What I don't understand is although I haven't used the card, they informed me I am over the limit? How can that be? So I asked for the payoff as of today and paid it off and closed the account and asked them not to send me any information about their card at all. I feel I have been ripped off big time. These harassing phone calls I received from Capital One put stress on me and my finances.

I obtained may Capital One Card around Sept 2005. I enrolled in the credit card protection services for an individual. I recently contacted the company to inform them that I was no longer interested in the program, they suggested that I can change my enrollment to an individual, not joint, to lower the cost. I then said why did I have a joint enrollment in the first place. I am the only card holder there are no co-signers. or other persons on my card.
I was told I should have notified them earlier, that I didn't have a joint account. I said, "I'm sorry I don't understand why would you enroll me in a joint account, when the account is an individual". There was complete silence. I was being charged $0.99 for every hundred, since 2005, until 2010. I should have been charged $0.59 for every hundred for the individual plan.
I would not have even known I was being overcharged, until I tried to cancel my services. Someone enrolled me up for the joint account themselves. All information needed was made available over the phone, to enroll. Someone knew that this was an individual account, not joint. There is only one user for the account. I didn't fill out any paperwork, all information was given by phone to enroll

I am writing you in response to a letter that I received from Chevy Chase Bank that stated: "Earlier this year Capital One Financial Corporation, the parent of Capital One, N.A., acquired Chevy Chase Bank. As a result of this merger, the creditor for your home equity loan or line of credit will now be Chevy Chase Bank, a division of Capital One, N.A. The loan we are referencing with this notice is" and it went on to say, "date of notice: August 24, 2009 loan borrower L H. Property address: *** Philadelphia, Pa 19150 Date of Loan October 2, 1997 Original amount of loan $18,835.39 loan no:2610408986."
It then goes on to give the address which is on the complaint form that I am submitting. "The date of the transfer which was July 30, 2009. The instrument representing the indebtedness of your loan (promissory note) is not a recordable document, but the promissory note is in our possession. The security instrument (deed of trust) that secures the repayment of your promissory note is, however, recorded in the public land records in the applicable jurisdiction. If you have any questions about the notice or would like to contact someone authorized to take action on your loan, please call us."
So I contacted them about the loan, that it was paid off but I was curious as to the amount of the loan and as far as the pay off and they said that the payoff of the loan was $11,058. You see, when I paid off this loan, I argued back and forth with them about the payoff of this loan and maybe I made a stupid move because of trying to settle my mother's debts. I just thought the pay off was just too much. Now, they told me that nothing was ever paid on this bill but there were payments made up until the death of my mother in September of 2000, also after which was set up by her attorney Mark **. The pay off in the amount of 28,000 dollars was sent to them by Silk Abstract Company trust account.
When I confronted Chevy Chase or Capital One, they wanted to know why I waited so long and I explained the situation to them. Their response was and they were very nasty about it, what would I have them do. and I responded that I would like to have my money back. This, I was fighting for in the beginning. I had to re-finance my mother's house. That money should have been mine and not theirs. I am still paying on this loan. The only thing we got out of the refinance was $455.05. There were a lot of repairs needed to be done to the house. So I had to re-finance again just to pay AMC mortgage and now I am in debt to Ocwen. The money that Chevy Chase took from me would have been enough to make the major repairs. I just want my $16,942. Can you help me? Please!

In light of this situation, I run a lawn service, and only have or had two credit cards to make purchases for equipment, materials, gas, and so on. For the past 3 days, we have been bombarded with calls from Capital One shows up on caller ID. They do not leave a message when call goes unanswered. We called the number yesterday morning and discovered that Capital One was trying to contact us regarding a new offering: pay an upfront fee and no charge if we go over on the account. We declined the offer and asked them to remove our name from the call list and to stop calling. After that call, we received 5 additional calls from Capital One over the course of the day. We called again in the early evening and asked them once again to take us off their call list, as we were not interested in any offers.
Not more than an hour later, they called again. At this point, we spoke with a customer service agent who: 1) denied that he worked for Capital One, 2) could not explain why we were still getting calls from his phone number 3) laughed at us when we expressed our frustration with the situation. There was also a background noise of people laughing, cheering and having a good time, as if they were having a party in the call center. Very unprofessional. That agent ended up hanging up on us.
We called the 1-800# on the back of our card to cancel this account and went thru another run-around with that agent. They verified that the 1-800- number is in fact a Capital One phone number, but again, could not explain why they were continuing to call our number. As we tried to cancel the account, we were unable to verify the transaction with the agent. Thirty minutes later, we received another call. At no time was a supervisor or manager called in to assist us with our issues. Extremely bad customer service!

I have always paid my bill on time. I have not used the card in years, and the balance is around $1,100.00 - $566 of which is Capital’s various fees and add-ons and the amount which is "over the limit." Again, I have not used this card in years. In July of 2009, I lost my job and took a $28,000 a year pay cut. I also lost my health insurance for one month until I could start paying for it myself and during that month I had emergency eye surgery for a torn retina which amounted to a $7,500 hospital hill, $3,500 surgeon bill, and an $820.00 anesthesiology bill which I am having to pay monthly out-of-pocket. I had to pay the hospital $1,000 down at the time of surgery.
I explained all of this to Capital One and asked that they put me in a program where my monthly payment could be around $25.00 a month, fees would be frozen, interest rate lowered, all in an effort to pay the card off and close the same. They did put me on such a program, but unfortunately I have today found out that they continue to charge over the limit fees and "past due" fees on the account and that they actually only waived one of their fees at the time I was enrolled in the program. I was also told today that the $25.00 a month was not enough and had never been enough to keep my account out of bad standing with the credit bureaus, something I was never told.
I was also never advised to use my payment protection plan which I paid for each month and then found out today, when I asked about it, that they had cancelled it, without notice to me, because $25.00 a month was not enough for "them" to continue paying for the plan. Excuse me, but wasn't I the one paying for the plan, not Capital One?
Now they want me to start paying $42.00 a month beginning April 15, otherwise, they will charge off the account as a bad debt, which I do not want. I am afraid they have already damaged my credit. I only have two credit cards, which I do not use, the other being Chase. Chase is working with me on a liquidation program where the card has been closed and I pay $24.00 a month without any negative ratings being reported to the credit bureaus.
A jump from $25 to $42 may not sound like much, but it is still money that I need to live each month while trying to pay my regular bills and medical bills, and I feel like Capital One is fraudulently representing their hardship program and then continuing to charge over the limit and past due fees even though the card has not been used in years! I do have a full time job now, but the $28,000 a year pay cut really hurt, as you can imagine. This is very stressful in my present financial situation. My mother passed away unexpectedly in June of last year and losing my job the following month (July) and trying to pay everyone and keep everyone happy is just about to take a toll on me. Please help if you can. Thank you.

Trying to pay off Capital One card (have two issued by Capital One). Low credit limit, $700. For several months, I was paying the minimum of $29 due, but the available balance remained at -0-. I was relieved, thinking they had cancelled the card and I could avoid the $4/month "membership fee". I pay my bills on the internet, and the 2 Capital One cards are linked under the same log-on.
Each time I clicked on "recent transactions" for the Platinum card, it would show "no transactions". I did not pay attention until I happened to catch this: even though I was making payments on the Platinum card, when I clicked on "recent transactions", it would redirect over to the Gold card - the only way I discovered this was by noticing the last 4 digits of the account had changed in a very non-obvious manner (no change of screens, no flags, nothing). When I was able to maneuver back to the Platinum card, I discovered that for many months. C1 had been showing a $29 minimum payment due, but charging me $39 a month in over-limit fees!
I tried contacting them via email and was sent a generic message of "please call." I called, couldn't get through because I don't have the card number (cut them up months ago) and could not get through to a live person. Now the bill is $1400 and I am livid. They have just done the same thing to my husband. Minimum payment is $29, then charging $39 in over limit fees, with no recent transactions showing!
I am sick over this, literally. And angry. And I would love to find a lawyer who wants to make Capital One payback everything it's stolen (yes, stolen) to the point Capital One folds. Credit card issuer Capital One Bank charged Maceo (customer) $568.00 for membership fees and credit card late fees after his account was settled and closed in February 2005. Without the customer’s knowledge, Capital One continued charging the customer $29.00 per month for late fees from 02/2005 up to the day the customer received a credit report via Chase Bank. To make matters worse, Capital One reported these charges as delinquent past due payment to the three national repositories as well as the credit score developer: Experian, PO Box 2002, Allen Texas 75013, Telephone No. (888) 397-3742; TransUnion, PO Box 1000, Chester, PA 19022, Telephone No. (800) 916-8800; Equifax , PO Box 740241, Atlanta, GA 30374, Telephone No. (800) 685-1111; and Fair Isaac, 200 Smith Ranch Road, San Rafael, CA 94903. Telephone No. (800) 777-2066.
According to Capital One Recovery Section Manager (Ms. Laura, ID no. **), she admitted to the customer (Maceo) on March 18, 2010 approximately at 3:45 pm MST that the account was charged off in February 2005 (paid in full). Capital One’s deceptive, unfair and bad business practices continued for five years, charged the customer for late fees accumulating past due payments of $568.00, whose account was settled and closed in February 2005. These errors on the part of Capital One have caused a tremendous amount of emotional distress along with several notices of credit denial. My job search was impacted by the negative comments submitted by Capital One.
This is the only balance that impacted my credit report. In December 10, 2009, the customer was rejected by M&I Dealer Finance Bank. This was the same bank that finance customers $32,000 in June of 1999 for an automobile. On March 18, 2010, Chase Bank refuses to refinance customer home because of the derogatory credit ratings from Capital One. Thus, this long term past due balance from Capital One has resulted in approximately 44 point average drop in customer credit score, which translates not getting a 30-year fixed 5.00% mortgage rate versus customer current 6.20% mortgage rate. This mortgage rate denial by Chase Bank resulted in the customer losing tens of thousands of dollars because of the poor business practices and poor follow up by Capital One.
Conclusion: Restore customer credit rating to the 700 credit score level. Reimburse customer the difference in dollars between a 6.20% at $407,000 mortgage versus 5.00% at $407,000 mortgage because of the derogatory credit rating caused by Capital One. Customer is seeking compensation for mental depression from dealing with Capital One Management Team; Capital One should pay all attorney’s fees. This is an example how Capital One continues to take advantage of good customers who work very hard to pay their bills and they still get a raw deal and lose credit reputation. Yes, I would love to have an attorney to contact me about my complaint.
