Monday, June 30, 2008 Bank Of America So here's where the frustration begins. I have a family, Two Kids wife dog house etc... The children are of a age where mom stays home to take care of them and we have a limited income. We had a previous account at citicenz bank and just never got around to closing it. Apparently this account was over-withdrawn by a about $1.20 and reported to Chex Systems where Bank Of America took this information from the banking reporting company and froze our account. Under normal circumstances, this wouldn't be a problem. we found out about this at Friday 8pm EST. The office that froze the account is open mon-fri 8-4. Fine, we will go the weekend without access to cash, Kids dont need food or diapers right?
Monday morning comes, I call BOA at 8:15 to resolve the issue. I was on hold until 9:45 until I hung up the phone and decided to go to the bank in person. I went to the bank where they in turn actually called the same number that I did and said I had to call Chexsystems to resolve the issue. I used the phone at the bank and called chexsystems. They told me i had to file a request for the report and it would take 5-7 business days for the report to come through the mail. I STILL HAVE NO MONEY... and the account balance is about $4500.00
So at this point the only thing i could think of is that Citicenz bank had somthing to do with this, because i still have NO information from Bank of america. Did I mention that my paycheck was directly deposited into the bank this morning. Insisting that bank of america release my funds, and they didn't. Finally I came home and called bank of america. They at least told me that the report was from Citicenz bank and a check from BOA will be mailed to us on the 15th of july. GREAT- So how do I go about my daily life until the 15th?
have no access to money for food, gas, diapers, bills and paying my mortgage on time

i was wrongly overdrafted four (4) times through this bank. first overdraft i received was for a savings account i requested to have closed & it said on my online statement 6/26/08 insufficient funds in savings, then to be changed to overdraft item fee in which they pulled up a charge to make it seem as if i actually overdrafted & changed the date on that charge that i payed for it.
i'm fairly certain that no matter how long it is in the pending process they cannot change the date it was made on. the last three were just outrageous & they pulled up charges the same way. i will be stopping into the bank to show them proof that i placed those charges on different days in hopes to get my money back.
i lost $185.00 through their shady dealings, & subsequently cannot pay for my medications for a herniated disc in my back & for general needs. i make minimum wage, work three days a week, & they are robbing me of all my money.

I had 10 overdraft charges in 3 days. Everytime I talked to a cust. serv. rep. I would get a different story. If one was to look at my bank statement you could clearly see there were some errors made because my deposits were not showing up and the only thing that was showing was my card transactions as if were done purposely so I would get charged.
I also had a situation where made a cash deposit at the atm and the atm malfunctioned. I called customer service and they made a credit to my account and after the so called investigation they took the money back. I made several attempt to make my case but I constantly got the run around. I asked for security video to show that I made the deposit but no one wanted to help. Basically they were saying it was just my lost..too bad.

With now two separate credit cards (accounts) on consecutive occasions, Bank of America has sent out the statements so that by the time that I receive the statement I have a week to get it back to them or pay interest. This is clearly an attempt by Bank of America to: 1 - Charge interest to people who pay their balances on time, every time. 2 - Move their customers to pay immediately via electronic payment or 3 - Move their customers from credit to debit cards.
In any respect, I find this practice unconscionable and outside the bounds of the credit card agreement executed between the consumer and Bank of America. I am put in position to pay usury interest rates on a credit card on which I pay the entire balance via US mail within 24 hours of my receipt of their statement.

Another debits before credits story. I made a deposit at the local Wachovia branch before 1:00pm and the next day my deposit showed on my account...followed by a NSF fee for a check amount that was less than the amount of the deposit.

written on a Wachovia account. The check was for $1460.00, and the teller handed me back $1455.00. When I asked where the other $5.00 was, she said that there was a charge for cashing the check. I feel that this is stealing. When I expected the check as full payment I did not agree to pay $5.00 to cash it. Had this been a check for $5.00, it would have been worthless.

I can't get my money out.
I never chose to be a Wachovia customer. My previous employer did that for me when they transfered our 401K accounts to these slime balls.
When I changed employers, I wanted to roll my money over to an existing IRA at another institution.
The first challenge was locating the correct Wachovia office to handle the request. Customer Service couldn't help me. I had to talk to the Distribution office, which has limited hours, weekdays, office hours, eastern time.
So I waited until that office was open again, called in, requested the roll over. They refused, telling me the account could only be closed via a "distribution" directly to me with a check made out in the other institution's exact legal name. Did I have the exact legal name of the institution? I was told that if the check was made out to anything other than the exact legal name of the institution, per the other institution's instructions, the check would be rejected.
So I contacted the other institution, which provided the magic name, but not before the Distribution Office had closed.
So I waited until that office was open again, called in, requested the distribution. This was 2 June.
Waited a week. Nothing happened. Waited a couple more days. Nothing.Called in during the tiny office hours. The check had been mailed 6 June, they said. This was 18 June. I was advised that no action could be taken until 10 business days had passed since the issuance of the check. The way they count business days, that meant 24 June.
At that point, if I still had not received the check, I could request that payment on that check be cancelled and another check issued. So, the 24th comes. I request the stop payment and the new check.
I'm told I have to fax or mail a "Lost Check Acknowledgment and Repayment Agreement" on the check that was issued 9 June (three days after it was mailed).25 June, they fax me the form. It has to be signed and notarized. Then you can fax it back, but if the seal isn't legible, they can reject it. Or you can mail it in.
There are a few problems with this scenario: In five plus years at my current address, I have exactly one (1) delivery problem, and that was with United Parcel Service, not the U. S. Postal Service. So it's unlikely a check was ever cut, much less "lost in the mail." The notarization requirement protects no-one from anything, but it does let Wachovia continue to hold the money without having to pay interest on it for another two weeks. Or more.

My wife deposited a $500 payroll check into our joint checking account on 6/23/2008 by handing the check to the teller at a local Wachovia branch. She asked the teller when the funds would be available prior to making the deposit to confirm that the money would be available to us in a satisfactory time frame. The teller informed my wife that the funds would be available in our account on 6/24/2008, which is the following business day. On the deposit slip provided to her at that time, it clearly shows in black and white ink that the deposit effective date is 6/24/2008.
First thing this morning, 6/24/2008, I checked our account online to verify the funds were available as expected. To my dismay, not only was there no indication of a deposit ever being made, but my account is now overdrawn incurring $44 in unavailable funds fees. The check that I had deposited the previous day should have been available, which would have prevented this overdraft from occurring. I called Wachovia and explained the situation. I was informed by the phone representative that she agrees with me, and I should get refunded the full amount. She then transferred me to another representative.
The new phone representative informed me that she sees no record of my deposit, and it should show up at 12:00 AM on 6/25/2008. I informed her that my deposit slip indicates that the funds should be available today, not tomorrow. I was then placed on hold, so that she could contact the local branch for verification. I was informed that the branch manager could not find any record of my deposit, and could not remove my overdraft record or refund the fees incurred. It sounded to me that I was being told by my trusted financial institution that my deposit had disappeared, and may turn up the next day. The phone representative then became very defensive, and insulted me by telling me that I charged too much on my card, and then made a deposit to try and fix it.
I did not spend more than I had; the bank just screwed me over. I told the phone rep that if the funds are not available until after midnight, then it would be the 25th, not the 24th as I have been informed and have in writing. She then told me that I am entitled to my opinion. OPINION? That is a statement of fact! I can't believe the hassle I am having to deal with. I have been a Wachovia customer for over 3 years. I have never been overdrawn, and my account has been in good standing since day 1. I use direct deposit (for me, wife receives a paper check), and I have never made a complaint before today or requested a refund for any fees. I can't believe the bank won't support me in any way after trusting them with my finances for years in good standing.
I plan to refinance my house this summer. With lenders already tightening up, what kind of interest rate am I going to get with a recent overdraft on my bank account? This is not acceptable. This is not the first time I have been unhappy with Wachovia, but it is my first complaint. Now that I no longer trust Wachovia, I have to go through the hassle of opening a new account with a different bank and notifying all my direct debits of the new information. My direct deposit will take a couple of pay periods to update. I am extremely dissatisfied with Wachovia and will make sure as many people know about this as possible for their own protection.
I was deceived by my bank, charged fees as a direct result of this fraud, and then doomed to higher interest rates because of the overdraft record in an already faltering economy.

The bank put holds on several items, that they charged NSF fees for, then charged overdraft fees. Online and on my print out, there was sufficient money in the account, the first two times, therefore, there should have only been one of the overdraft charges.
When I went to the bank with my online banking print out to ask why they took money when there was enough to cover the items, she said that they had added up the items while they were being held and charged a NSF and then when they actually came out, they charged overdraft fees! I was charged tripple fees because they took money out for the same thing 3 times, at $70.00 for two, and $105.00. The lady offered no customer service, she just stated that is what they do. I closed my account.

I deposited a check into Wachovia's ATM for $600. I called their 800# to make sure I received the $100 courtesy allowance, the balance was $103 per the automated system. I went to two grocery stores and spent $44 and $38. The next day, I received 3 OVERDRAFTS in the amount of $105. I called furious, they said that money is only available for cash withdrawals not debits. WHAT? The overdraft charges were for 3-$3-$4.00 debit charges that had already cleared two days ago. Please someone help me to understand this?
They will only refund 10% of the $105. I told them that I am not accepting this deal and that they are in the wrong. Actually almost fraudalent! How can they switch my transactions to make it seem that I am in the negative. What kind of game is this? In the last few months, Wachovia has been backing out my deposits for a day and applying debits first. Even though the online service that day says the money is available, next day it's processing. How can they get away with this?
Consequences...I have lost at least $35.00-$105.00 a month to Wachovia and their 3-card Monty bank services. As a Realtor within a slumping housing market, I need every dime I have!

I feel that it's one of the worst banks you could possibly do business with. I've been a customer with them for 5 years, and they recently charged me over $700 in overdraft fees in one day. Apparently I had pending transactions that went though which over-drafted my account. On the day this happened, I was using my debit card all day in the subway ($2 a pop) with no knowledge I was over-drafted, and they were letting the transactions go through. They charged ($35) every time I used the card, which at the end of the day, for about 40$ in transactions, they charged me over $700 in overdraft fees.
I had plenty of money in my savings account and credit card to cover the overdrafts, but they made no effort to cover me, or alert me that I was over-drafting. When I called to ask about at least getting some of it refunded, they treated me like sh*t and said there was nothing they could do. Now, $700 isn't a crazy amount of money, but the fact of the matter is, they're scam artists. What other company do you know of that is allowed to charge roughly 170.5% interest on borrowing money ($700 they charged % $40 I borrowed.) There are laws against this kind of thing, but apparently there is no law governing how much a bank can charge in overdraft fees.
I feel as though there should be more laws written on banking practices. I take the blame for not balancing my checkbook as well as I should have, but I'm outraged at the penalties banks charge people for this, it's a legal form of robbery. It seems all I can do now is spread the word!
Wasn't able to pay half my rent this month, had to borrow money, at interest, putting me further in the red.

They placed a 2 week hold on a payroll check that I deposited by ATM. I have direct deposit, from the same company, that goes into my account every other week. This specific check was a bonus and without mentioning the hold by email or mail or phone, the bank placed a hold from 6/16/08-7/2/2008. I thought that I had money, and used my debit card for $1.61 coffee's and $2.00 parking fees.
In addition, I have written checks and made payments online and almost everything has been returned or will be returned. I have tried to contact the bank by phone and email, no one is willing to explain why this has happened. To make matters worse, the fees they are charging me are $35.00 each, plus all the fees that the merchants have/are going to charge me.
I already have over $460 in fees now! I am a single parent and I live in a very expensive region of CA, I'm not even going to have gas to get to work or have food to eat. I am afraid that when I get paid on 6/27, they will eat up my entire pay check in fees!

I have over draft protection on my checking account at their bank. How it works is when i overdraft it automatically charges my credit card $100 and it deposits into my checking so i never go negative. I went on vacation at the end of march to early april and I was using my debit card with no problem and no worries. I get back from vacation and deposit a $300 check into my account and I see that my account was $650 negative. This was a sunday night I had to get back to school that night.
So the following weekend i went to the bank on a saturday, and spoke with Ed. He said yeah i don't know why you were charged, he called the main office and the person on the phone said I shouldn't of been charged either. Ed said i was going to get my money back and he would give me a call on monday. Ed never gave me a call. I went back into the back a couple of weeks later. The women I spoke with wouldn't even talk to me she said Ed would give me a call he never did again. I went to a different location to talk with a different representative. She could not give me any answers either and said she would call me. She never called me either.
I went back to Ed. He said I payed a credit card payment late and that automatically unlinks the overdraft protection. I was never told that I didn't have protection anymore. I was never asked if I wanted to relink it after I payed. After my vacation I was left to live on my credit card. I had $350 in my savings and they took the money out of my savings and put it in my checking to pay off the balance with out me knowing it. This bank is wrong and cost me a lot of money and debt. Also if my account was over drawn why would it let me keep using it to rack up $650 that should not be allowed especially if i was unaware.
I have had to live on my credit card while away at school. I lost $650 dollars, and suffered extreme embarrasment.

i had a bofa checking account my daughter stole some of my checks and preceeded to write out and cash them i paid off the checks as they came in i cntacted bofa and told them and ask them to close out the account from nov of 07 and up through april of 2008 they would still allowing hte checks to come thru so they could charge overdrafts fees, and they didnt close out the account till 01/08
they now have me in same claims court for overdrafts fees in the amount of 1945.03 even tho i had called them over and over and ask them why they were charging me overdrafts fees on stolen checks and why they were allowing those checks to run thru 3,4, and 5 times each. every csr i talked to could not give me a reason why all they would ever say it is your account and you are liable for it even tho i had ask months beofre to have it closed out and reported the checks as stolen, they would not and had not recorded the checking account as stolen
now i will have to pay all those charges plus maybe criminal charges due to their neglengence

I recently moved to Salt Lake City, UT where Bank of America does not have a physical bank location. Since my checks get direct deposited anyway, I chose to keep my BoA account open but for the few occasions I have a paper deposit, I have to mail it in. I fedexed a deposit and waited for it to show up in my account. It showed up as pending and I used my debit card. However, the still showed as pending the next day but my charges cleared.
Since I made the assumption the pending deposit would clear, I won't beef about it being held longer. HOWEVER, even without the deposit, I still had $47 + change in my account. My debit card charges were $29 + change and $20 + change respectively. Only ONE of those charges would have caused an overdraft but they charged me $70 in OD fees for both?
The CSR told me that they sent out an account update in December stating the change in the fees policy. Now they will charge fees for all debits they process the same day if the account goes into the negative. I asked the CRS you mean, even if one of the charges doesn't cause the account to go negative, I get a fee because both charges were processed the same day? She said yes. HUH?

my son had a account, me and my husband have an account also, my son who is in the us navy, had some issues and over drawn his account . we have told wachovia several times that my son was out to sea and they needed to send his overdraft notice to him, gave address and number to the bank. but they never contacted him about his account.
what they did was went into my account and emptied it of 686.56, to cover my sons account. no notice to me i find out when i go to pay my bills and find i have no money in my account. first i call cust service and questioned. they say nothing we can do and hang up on me. i then go to the branch office in middle river md, to be told thats our policy and if you dont leave we will call the police to remove you.
i then call back the 1800 number to then be told very rudely that we are not getting our money back because thats our policy, thats my sons account, my own personal account has nothing to do with my sons overdraft.its totally wrong that the bank can just transfer money from peoples accounts to pay other peoples bills. without any notice at all. i asked the rep if they were gonna pay my bills and overdraft fee due to they stealing my money she says that i need to call the companies i owe money to to make other payment arangements because they will not give me my money back

A hot shot salesman in Florida called my wife and stated that he was now our Wachovia contact and he had a deal that would pay us 8% per year. My wife said that is too good to be true, send us information. After he hung up, he sold our Government Bonds that were maturing with out our permission and bought Wachovia 5 Year special C.D.'s. I could not believe he could do this and contacted our local rep. He said, since this guy may come up on charges, he could no longer represent us because Wachovia would fire him if he was involved. I went through Wachovia, who gave us a long line of stall and basically said they could do nothing.. This conversion cost us thousands of dollars so far and the CD has not matured yet. Almost $200,000.00

I've lost nearly $400 this year to the same sorts of Overdraft/NSF charges that these other folks are complaining about. The online banking isn't worth the webspace if the balance available isn't really available. Five times I've been charged twice for an item...a charge would be listed in the Check Card Hold area, and any items moving to the transaction area of my account that night would be charged the OD/NSF charge, and so would that item that would remain in the Hold area. The next day, unless I hurried, begged, and borrowed enough money and got to the bank in time, the item that was coming out of the hold area would be charged AGAIN(!!!) when it was moved to my transaction area.
Add insult to injury, just today, I see Wachovia has added a Deposit Holds area to their online banking. How insulting! I've been a customer for 30 years. For my JuneYear's Resolution, I've opened an account with a competitor, and will completely be out of Wachovia within 30 days.
Like many others, I live paycheck to paycheck, and that $400 hurt deeply, putting me behind with several of my regular creditors.

We have been a long time commercial customer of Bank Of America. We utilize our debit/checkcard to provide payment to our vendors daily for work that they do for us. There can be as many as 20 transactions in a day authorized by our vendors to our card. During the day and evening the transaction will be sitting as 'pending' in the online bank statement we can review. Often Bank Of America will allow the bank account balance to go into the red for pending transactions. Normally we will transfer funds to cover these pending which automatically removes them from the red or negative status prior to posting with a date.
Occasionally, during the month we may miss doing this by 12 midnight and a pending goes to posted with a date. This would show up as a 'red' negative to the account in the dated transaction section. We are in agreement with the bank that once the pending goes to a dated red negative it is an overdraft. In the month of May, on one day, 10 of these pendings went to red negative dated. Therefore we expected a $350.00 overdraft fee for this error, as has happened in the past. We agree it was an oversite. We have never been charged overdraft fees for pending items that did not move to the section with a date. As long as we cover the pending before they moved to an item with a date we were fine. For two years we worked under this premise and were charge minor monthly fees for a small amount of overdrafts that slipt by.
Today we were debited $3300.00 in overdraft fees which were ACHed out of our operating account without notification prior. Of course it put our account in the negative which we had to cover to avoid problems. Our Accouting/Office Manager reviewed the transaction in May and could only locate the 10 overdraft items we anticipated on the statement. All other pending items that appeared negative were covered before the posted with a date. Bank Of America is now claiming that they consider there to be 90 overdraft items for the month! Although we only see 10.
We spoke with our bank assistant Shasha out of Point Pleasant, NJ. She indicated that she could prove 90 overdrafts and would fax over verification immediately. She has not done so as of yet. We tried to explain to her that we have not changed the way we cover our pending transactions and that we only saw 10 overdrafts. She rudely insisted we were wrong, and that their banking practices and rules had not recently changed, although it appears that they are now charging us $35.00 for 'pending' transaction that go in the red even if we cover them before they date.
We have just been charged 10 times the normal fee we would expect. We are at a loss as to how to handle this situation. We feel that Bank Of America played it underhanded by changing the overdraft rules mid-year to get funds and fees from our account on transactions we never were charged on for two years. Just when we feel that we have learned the rules of Bank Of America they change them to invoke more fees.
Our corporation lost over $3000 in revenue because of Bank Of America's trickery, and stand to lose another $3000 next month because we no longer have a handle on their rules and the games they play. If they can not prove 90 valid overdraft transactions according to the rules we have abided by for over two years, I am considering contacting my corporate attorney.

pulled $564.05 from my checking account and can not explain why they pulled that money . I closed the account.
I recieve a letter from collection agency for $218.40 for fees associated with not using the account and having a negative balance from the time they pulled the money from my account.

A Wachovia employee called me and asked if there was anything she could do for my business checking and savings. It was crystal clear that she wanted to SELL me something, not ASSIST me with anything. After speaking with her for a few minutes, I told her she could help me with ordering a box of checks. I have never in my life paid for checks and had no idea she planned to charge me for checks.
I found out later that Wachovia has a new no fees business checking account, but she never mentioned this to me, nor has ANY Wachovia employee mentioned it to me despite seeing me in person at least once a week. I got the checks and found out she sucked $21.00 out of my account without notification nor permission. If I had known there was a charge, I wouldn't have told her to order checks. Like I said, I've never paid for checks in my life. Why would I start now? Basically they lied by not informing me of any charges for checks.
Lost $21.00 through dishonesty as far as I'm concerned, but I have also spent many hours trying to deal with the customer service people at Wachovia.

July 2007 I made a online purchase using my Wachovia check card for the amount of $133.00. After not recieving the items I bought I contacted wachovia and filed a chargeback for the said amount. The money was put back into my account only to be taken out a week later again. I stopped using the account and contacted wachovia again to see why they said I needed to file a hard copy with disputes dept. so I did instead of mailing it in I got there fax no. and faxed it in.
I contacted wachovia for the third time only to be told it was too late. At this time I had a 6 or 8 dollar bal. in the account and told them to close the account. I was so [upset] I just threw my checks and cards in the trash, only to find out later they neglected to close the account and someone was trying use checks for all kinds of stuff, dept. stores and even tried to pay a motgage with a check # I didn't even order yet. They never paid any of the checks but with the nsf fees pileing up wachovia finally closes the account and turns it to a collection agent.
Now not only am I responsible for the checks wrote but wachovia wants all the nsf fees collected and is ruining my credit with the collections depts.on it just because a wachovia employee neglected to close my account when I requested them too

One Fri before going out of town a few years ago I deposited a check in the ATM near my home @ local branch which was closed for the day, got my receipt with my balance & went in my merry way. I went out of town & attempted to get cash but to my surprise on Sat night, I was in the negative! I called customer service & he explained even though my receipt said 1 thing it wasn't my true balance because I missed the cut off time. Made no sense 2 me but I also explained 2 him I was hitting the credit button so the charges hadn't even posted, but he said that didn't matter. @ that time the guy agreed to waive 1 of the 9 or so fees, I was upset & didn't want to argue about it with everyone around & figured I would call back later.
Ha, guess the jokes on me because the reps kept telling me since I agreed to one fee that's all I was getting like I was bound in a legal contract. So now of course I am n chex systems for boo-koo $ that I still can't understand how I owed it when the $ was already deposited. Oh did I mention I was a signer on my moms account & wachovia messed her up 2 so she didn't pay & they took the $ out of my checking account! UNBENOUNCED TO ME! I can't stand WACHOVIA & their shady practices.
I am currently in check sytems & cannot change my checking account # with my credit union because the process req closing & opening a new checking account. Fortunately no one found those books of checks I lost

I had a bad day today. I recently opened up a new account at the Bank of America. I opened it on April 29th this year. And so everything was going well...I made a small mistake with my address since I am new to Miami I wasnt sure whether I live at 70th or 71st street...but it was 70th street...so I changed that like 2-3 weeks after i opened the new account. And the rep said that I would recieve my card within 10 days...nothing happened, but I was patient I waited for a little longer and just yesterday I went and spoke with them personally and everything seemed fine...they gave me a temporary card and I also deposited the cheque my friend gave (he owed me 1645.50 ) as well which was the only deposit in my bank as well...
So next we went to his bank (Washington mutual or something like that) and his rep even told us that what they are doing is ridiculous and that Washington Mutual never put a hold on the cheque or anything like that. So then I called Bank of America Customer Relations and they told me in a very very rude manner that my account is closed and that I would recieve the money in my account from them as a cheque to my place without any explanation of why i was being accused of forgery. I cant believe this has happened and I cant believe that I am being alienated and treated like a piece of garbage by these ppl and I didnt even do anything wrong. I am very upset.

I have recently had some very troubling issues with Wachovia Bank. In short i have been charged $595.00 in a week for 17 non sufficient funds/over draft fees. My wife went to one of our local branches and asked for their copy of our transaction record. I reviewed the transaction record given to us by them and parsed it line by line with a calculator. only eight of the original 17 nsf/ od's are valid. The rest are either two of the same fees assessed to one transaction or they are assessed before any actual payment is made or overdraft incurred. Each fee is $35.00 and the total of the nine that are wrong equals $315.00.
I have since gone back to my local branch and discussed the problem with a customer service representative. They told me there was nothing that they could do and that Wachovia banking policies were clear and had not changed. Should Wachovia, with the BBB's urging, right the wrong and refund 9 of the 17 nsf/od's there are still 8 nsf/ofd's to the tune of $280.00 for a total of $85.00 in over drafted funds. This is an appalling abuse of services to the consumer and needs to be stopped. I have researched the issue further on line and found that there is no small amount of abusive banking practices leading to the success of Wachovia and it's enterprises. I am very interested in finding out what can be done about these policies at a legal level.
Overdrawn almost $450 and have no funds available until next pay period unless I continue to overdraft my account

Opened an accout online as we were moving from Oregon to Michigan and had to switch to a bank that was local. They told us LaSalle Bank, Midwest had been bought out by BofA and that in May, it would be a full working BofA branch. It's not! Since we had opened an account online, it took us 3 weeks just to figure out what our routing number was and that was with BofA's assistance.
We had requested documents from the Customer Service phone people and here we sit, three and a half weeks later waiting for them. Just had Kitty from BofA customer solutions call and ask us if we still needed them (duh, yes) and asked her if they could expidete them since we had been waiting for all this time and she told us that it would cost US $15 to fedex them. She was very rude and discourteous and didn't care what the situation was.

I reported a check fraud on my checking account on Jun 10. The bank helped with getting my money back and said that if I would like to put a security hold on my account then I can call back and do this. I did call back and asked that they do the security hold, they put the hold on my debit card. 2 days later the same check fraud came through taking more money from my account, and caused anover draft.
I called the bank but they said they would not help me becasuse I did not put the security hold on the account. I explained to them that I did put the hold on there, but the guy from there bank put it on my debit card instead of my checking account. They said that they would NOT help me, and I would have to pay the fraud check and 3 35.00 fess that they were putting on my account for the over drafts. I did what they told me. The guy at their bank screwed up and now I have to pay the price.
I now have to pay the fraud people and the bank their fees.

Four overdraft fees that should not have occurred. Our register and the on-line statement provided by BofA agreed. However; the statement that BofA uses (that we, the customer do not see as verified during a telephone conversation on Feb 13th) did not agree. Basically, BofA said we made a $44.33 mistake. When asked to show us the mistake they (Ms. Carpenter a supervisor at BofA) could not show the mistake. I told her I disputed the fees and wanted a refund. She said no, it was our mistake but could not or would not prove it to us.
This has happened several times. I want everyone to know two things. 1. The on-line statement is not trustworthy unless it benefits BofA. 2. If this happens to you PLEASE FILE A COMPLAINT WITH THE OCC!(Office of the Comptroller) When I asked the BofA rep where I could file a complaint she suggested the in-house BofA complaint procedure and the BBB! When I asked her about the OCC she said she haad never heard of them!
I am diabetic. As a result of this creative manipulation of our account I was unable to get my perscription filled so I am out of medicine tonight, tomorrow and well, until we get enough money to cover these incorrect overdraft fees and I am unable to purchase any groceries. I informed the BofA supervisor (Ms. Carpenter) of this but she didn't care.

Wachovia Bank has a 2pm cutoff for cash deposits. That is to say if you deposit cash to your account after 2pm, it will not be posted to your account that same day. It will 'officially' show as 'processed' to your account the next day.
Yesterday (6/10/08), I made a cash deposit to my account after this deadline. I then called the 800 number and talked to a representative named Carol A. I told her that I had made a deposit after the deadline and that I was afraid that since I did so, I might be incurring an overdraft fee for a charge that would most likely be debited from my account the following day (Wachovia charges $30 for each instance of overdraft). Carol assured me that since I had deposited cash, an overdraft fee would not be incurred for any charges that hit my account the next day. I want to be absolutely clear at this point and say that if Carol had told me at that time that since the deposit was past the cutoff time, I would be incurring an overdraft fee, I would have let it go. But, as stated above, Carol told me that I would not have a fee.
The next day, there was $30 charged to my account for what amounted to be a $4 overdraft (which technically was covered by the cash I had deposited on the 10th). I called back and I was told by numerous representatives (most of whom seemed pointedly uninterested in the fact that someone who worked for Wachovia had told me that I wouldn't have an overdraft fee) that I was at fault and there was nothing they could do for me other than offer a courtesy refund of $4 which I finally accepted after what amounted to over an hour on the phone with them. One reprehensive named Antoinette M seemed utterly incapable of grasping the concept that I had been told by one of her co-workers that I would not have an overdraft fee. After explaining the situation to her no less than 3 times, she could only iterate that since I was at fault by depositing my cash past the deadline, Wachovia would not refund the full overdraft fee. She told me it was her company's policy for her to not give out her phone number and extension should I need to contact her again.

I have an auto loan with Wachovia which I have had for well over 5 years. I have NEVER been late on this account. On May 28th, I paid my bill. On June 9th, I received a letter in the mail stating my payment to Wachovia was short by $70. I knew I would be 30 days late if the additional payment did not post to the account by the 15th of June, so I scheduled a payment from my Bank of America account to post on May 12th.
In the meantime, WITHOUT authorization, Wachovia automatically deducted $70.04 from my checking account and THEN hit me with $70.00 worth of NSF fees. When I called Wachovia and explained they did not have a right to do that, the CS rep hung up on me. I was told the bank has a right to take funds out of your account if the account is deliquent by 25 days. I have NEVER signed anything in regards to this policy nor do I have anything in my loan papers regarding this policy.
I feel violated and I have lost 2 hours of work trying to straighten this out.

Bank of America set up a fee system that's just dirty. Used to be when your balance was at zero you'd be denied. I assumed that was the case. I moved my savings out of checkings and overdrew on my account. They charged me 25 to 35 per debit that i charged after I hit zero. It came out to about 300 dollars. 25 dollar fee every time i put a coffee on my debit on the way to work. It's criminal.

My daughter has a Wachovia student checking account linked to mine. Last night I checked my balance on-line and saw that she had less than $100 avail-able balance, including 3 check card and no deposit holds. I transferred $132.68 into her account, which then showed a balance including the transfer I had just made. This morning, 3 other transactions popped in between yesterday's balance and the transfer, resulting in an overdraft.
It appears that Wachovia intentionally posts debits before credits to maximize the chance of an overdraft, even if it negates a prior posted balance. From prior postings this seems to be common practice at Wachovia and, I think, should be investigated. It certainly is not customer-friendly.
This action resulted in an unnecessary $35 charge after the deposit had already appeared as available funds. It is as though the deposit was backed out to allow the overdraft.

Wachovia misleads you by letting you think you have enough in your account and actually giving you money from the ATM and then a day later you find out that you are overdrawn by a few pennies (23cents in my case) and they charge you $35 fee.
Additionally, other items that were on hold will start to come in and they charge you $35 for each of those items regardless of amount. I didn't even know I had Non sufficient funds, becuase a charge was made by a restaurant that was not supposed to have hapened.

I attempted to transfer money from my savings to my Wachovia checking. In reality I did the opposite (clicking error) and it cause quite a few overdraft fees. I immediately called and talked to John Rodel at extension 83742 and gave him the run down. He reviewed my account and said that because I was a good customer, he would credit me the NSF fees and to call back once I thought all my transactions had gone through, which I did a couple of days later.
Upon calling John kept me on hold for a few minutes and told me he would only be able to credit me 25% of the $455 worth of NSF fees. Had he told me that when I called the first time, I could have borrowed the money from my mother (another Wachovia account holder) to decrease the amount of NSFs. But because he assured me they would be taken care of I didn't bother with making any arrangements to counteract any of the transactions that were going to hit. I then asked to talk with some one else and was transfered to Tsequanesh Debretsion who kept me on hold for 5-7 minutes and then returned the same answer and then hung up on me.
I no longer feel safe having Wachovia hold my main account. I am down $350 dollars in NSF fees when it could have greatly been reduced if I hadn't been lied to. I had to borrow money because I have car rentals, home maintenance scheduled and child care to pay for and groceries to buy. I think I am going to take my money where I feel more secure.

After being fed up of paying fees, I called Wachovia and cancelled my overdraft protection (thinking this would avoid the transfer-funds fee) and asked they DO NOT approve any transaction that would bring my account into a negative balance. Sure enough, a few days later, Wachovia Bank paid out hundreds of dollars to a company that withdrew funds from my account without my authorization. After questioning Wachovia, they did tell me that the company did not obtain authorization and Wachovia doesn't know why they even released the funds to the company.
In any event, this caused my account balance to fall, leaving just a few dollars in my account. I used my check card like normal not realizing that money was removed from my account. Wachovia approved all of my transactions for the day and I did not even find out about ALL of this until a day or two later when I checked my account online. I was wondering if Wachovia was going to bother to call me to let me know what was happening?
Anyway, they of course added on LOTS of fees. The were Unavailable Funds Fees of $22, and then Non-Sufficient Funds Fees of $22 for the same transactions. No one at Wachovia could even explain these fees to me or how they were assessed. On top of it, even though they saw that I told them not to approve transactions that make my account negative, again they could not explain to me why they approved the transactions after i specifically asked them not to. From where I sit, it does not look like Wachovia cares anything about their customers and assess fees however they can and wherever they can. Their commercials claim they are number 1 in customer service...I don't know how that happened!
I have had over $800 debited from my account in an unauthorized transaction, plus $132 in fees from Wachovia, and then another $50 in fees from the credit card bills that I tried to pay from my account that were returned because funds were not available.

I had a cashier's check to cash that i was weary about and explained this to the staff when i arrived. I asked them how long it takes for one to clear and they told me that is takes two days tops and i got the check cashed and waited. I waited the two day they told me and went back to the same bank to make sure that the check had cleared. I specifically informed management again that i was unsure and that was the reason i was checking.
They told me in these exact words that there was no hold on my account and that the check was good and it cleared. Still insistent there could be a problem later i held onto the money for another two to three weeks to make sure that everything was fine. Figuring it was a cashier's check it should be almost fool proof, waiting the two days they told me, going back to make sure there was no hold, and still waiting three weeks before i touched the money; i figured that it was okay to disperse it like i had planned.
Then a little over a week later, June 6th, i my statement makes me aware that the money was charged back to me stating that they were not able to collect on it. After explaining the case again to bank manager they are claiming they have no responsibility for the other bank sending the check back late, because they are suppose to send back with in two weeks if it is no good, and then telling me they don't know why they could not get payment. I don't see how a large branch like bank of america cannot tell me within three weeks that a cashier's check for 3,950 is no good.
I am upset that the bank claims no responsibilty even after i took every precaution to make sure this would not come back to me. I am appauled that after i explained my suspician they didn't tell me to wait at least a month to be sure. I felt that they didn't bother listening to me and are so quick to say that they are not responsible. I told them from the get go that i do not have the funds to back up this check and that is why i am checking to make sure it has cleared. They actually thanked me for coming in to take that extra step and i again told them this has to be clear and that they are certain. Two associates, one being a manager checked and promised me that it was fine. And now they are charging me back this money and are not trying to pursue the bank that authorized the check.
This has created the biggest strain ever on both my family and my relationships. THey are refusing to temporarily freeze my account and waive any overdraft charges. This will hurt my credit because i don't know how or when i can pay this back even though i feel it is mistake on the bank's part that lead us here, and it is the bank's because of the promised i received amd the precautions i took. I just bought i ring for my girlfriend hours before i found this out and what should be one of the happiest days in my life has turned into one of despair and hardship. This problem with the bank has caused me severe depression and anxiety and i feel that life can not be good or the same for a very long time without some serious help

BofA closed my business account to further charges based on information we obtained from your account, as well as from information reported by a major credit reporting agency. I was not, and am not, in default on the account, or on any credit card account I have. Due to a late payment, perhaps two, over a period of two years or so, my interest rate at the time they closed off further charges was 19.24 on purchases and 23.24 on cash advances. Kind of high, but I have other credit, and I decided just to pay the monthly bills and not complain, which I have done, regularly, on time.
Yesterday, I received an amendment notice stating they're raising my interest rate to 27.99 -- not based on anything related to the closed account but again on information in the credit reporting agencies files. According to the BofA representative I talked to on the telephone just now, the increase is because they have determined I'm a risk. (My credit score does not bear this out.) I can't close the account to stop the increase (it's already closed). Apparently, they can do whatever they please, including charging me another $30 or so interest per month, just because they feel like it.

Wachovia Bank Charges Excessive fees. How can a bank charge you overdraft fees twice in one payperiod, not only did charge me thirty-five dollars twice for a $4.00 overdraft. The Overdraft resulted from the fees Wachovia charges for a customer using a non-Wachovia, ATM the Non-Wachovia bank charges you ATM fee, and Wachovia charges you for using another banks ATM. Each time I used the ATM in the building where I worked, Wachovia was charging me to access my own money, without ever informing me that this was their policy. So that when I realized that I had acquired a $4.00 overdraft, and Wachovia charges $35.00 for each overdraft.
I've been laid off for a year and a half, and I just got a permanent job this year. I'm trying to get back on track with my bills and rebuild my life. My home is in forclosure, and I'm about to get a divorce. How can a financial institution like Wachovia be allowed to double dip, like that and your not able to report it. FOR A $4.00 OVERDRAFT, WHICH WACHOVIA CAUSED BY CHARGING ME TO GET MY OWN MONEY FROM THEIR BANK THROUGH ANOTHER BANKS ATM......I WAS CHARGED $74.00. What can be done?

Wachovia decided to handle my debits instead of credits first causing my account to hit $210 in overdraft fee's. I am disabled and I will not eat this month because of it.
I am 100% disabled and I live on less than $900 a month and that includes paying rent. Be cause of Wachovia i will not eat this month. I am taking them to small claims court.

I have an overdraft account with a balance I want to pay down. I asked how I can apply the payment to the highest interest rate amount. I was told this is not possible, they have no ability to apply to the highest interest amount outstanding. I

After years of suspicion that BOA was ripping my wife and I off, the last straw has landed. On March 24, 2008 my wife and i purchased a trip package to cancun. The airline tickets were charged seperatley from the hotel package through Expedia. The next morning while checking my accounts i noticed that i had been charged for 4 tickets. Not 2 tickets as actually selected. Under further investigation we noticed that there were actually 2 sets of transaction #'s. one for my ticket and one for my wifes ticket, then the exact charges including Transaction # were Duplicated.
On top of that we were slammed with 150.00 worth of overcharge fees because that action as well as other banking actions had sent my account spiraling into the negatives. after some phone calls with some not so willing staff, we were givin a credit to make up everything. then 3 weeks later the amount of one of the tickets was STOLEN from my account by Bank of America. This being a holiday weekend of course we recieved a letter saying that the airline had declined any wrong doing. with little time and a hot head attempted to contact bank of america and like so many other people encountered BOA staff that was rude and discourtious.
this is know in the third month of this So Called investigation. I have since closed all my accounts except the one under contention. BUT i Will NOT GO AWAY. I work hard for my money and i am not going to let some bank who thinks that they are above the law. this is my money and they made a mistake and know they dont want to play by the rules and give me my money back. this has gone past the point of being reconciled. I want to be compensated for my troubles.

i had purchased a money order from money gram that had been stolen and wrongfully cashed by b o a. the money order has sent 2 demand letters to b o a and they have yet to respond. i would like to know why and when they will get this taken vare of.
i am still fighting eviction from my apartment complex becouse this was my jan rent. someone was arrested and will be sentenced for this crime this month. i would just like to get this money back so i can resolve this situation.

On May 20th, I checked my account online and had a balance of $8.54. I had my husband deposit $100 at 8:32am and another $351.36 at 10:16am. My husband asked the teller to cash and deposit the checks. This is documented on his deposit slips, which we have a copy of. The teller did not cash and deposit them, but simply deposited them, therefore BOA put a hold on the deposits until 5/22.
When I checked our account that evening online at 5:02pm, we were negative $118 dollars because they posted five pending transactions from 5/19 AFTER our deposit.
We called and talked to customer service at 5:10pm and she said that it was the tellers mistake because she did not cash and then deposit our checks as we specified. She said that there were not any overdraft fees and that we could go in the next morning to the bank and they would fix the problem. She recorded this in her notes. I checked the account a final time at 6:47pm and we were now negative $293!! They charged us $175 in overdraft fees after we had deposited $450 that morning!
The bank manager would not help us and continued to place the blame on us and not the teller! They also insulted me by claiming that I was not one of their premier customers so they would not refund me the fees! I have deposited over $40,000 with them since January! Just what does it take to be a premier customer!?

I travel all over the world and do not like to carry large amounts of cash but prefer to use my ATM card in the country I visit. I notify B of A before leaving to let them know that I'll be traveling to other countries and using my card so I don't have an issue. I went to China this week and used my ATM card with no problem.
I tried to use my ATM card again and found that it was blocked. I sent emails to B of A customer service and they told me the only way to unblock the card was to call a phone number in Atlanta. I told them that I had no phone and could not call. After 5 more emails, they still gave me the standard answer that I had to call to have it unblocked. Not sure why since I had to use a password, answer a secret question, and then confirm a site key before even sending an email. What's the point.
Needless to say their customer service rep's, all in India, did nothing but say they can sympathize with me. Not sure how since they were not stranded in China.

My pay dates have changed from the beginning of the month to the end of the month. I don't like to make late payments so I contacted Wachovia about changing the due dates on my car payment to better fit my pay schedule. THe woman I spoke with out of the local office faxed me the paper work, which I in turn signed and faxed back. SHe told me it would be for the current cycle and my payment was now due at the end of the month. Pretty soon I started getting phone calls ( 4-5 a day) in which I explained about the payment change, they told me it can take some time to update, apologized and told me to check up on it. I did and was told by Brian in the local office my request had been denied, i asked why that information had not been passed on to me and why it had not been availabel to the agents calling me, he said he did not know but suggested defering that months payment as a solution to the situation. I payed the 25.00 deferment fee, signed and faxed back the papers and thought we were all set.
I WAS WRONG!!!!! I received a call this evening from Wachovia, "Maam you are 31 days past due we need to arrange payment immediately or we will repossess your car!" I have not made late payments previously, I have been a good girl, pay like clock work and they were going to repossess my car? I explained the whole story beginning to end and asked why if I defered that payment I was late... the jerk transferred me to my local office (in a huff) where I was greated by another jerk who immediately started telling me there was no record of any sort of deferment offer, I calmly explained "I have a copy of ALL the paperwork here, its even time stamped from your and my fax machines" to which he replied " a whole lotta good that will do ya, you are still 31 days late, would you like to make a payment today or shall I arrange for a repossession?"
After a half hour of arguing back and forth I finally just made the payment asked since I had all the documentation if this would still be on my credit report, to which he replied " well you were late!" I said " but I had filed paperwork with you twice! and you guys failed to inform me of the first one being declined, this one you flat out lost!" he said 'prove it' I told him I had payed the 25.00 fee, he told me he didn't know what that was for for all he knew it could be for late fees. Mind you I have NEVER paid late and thus would have no late fees, something he could easily see on his screen. I hung up have left messages for ALL his supervisors for tomorrow and am waiting for this to show up on my Credit report. After this ordeal my husband told me to just pay off the F***ing loan so we will be taking the money out of our savings to do so. This was supposed to be a way to build credit as young married people starting out not get screwed by it.

I banked with Wachovia..well def. not anymore. I recently have been charged 2000.00 in over draft fees. I had companys just charge over and over again on my account and Wachovia did nothing to stop them. They re ran checks two and three times a day for different amounts of drafts. I ended up with all that in over draft fees. I have not paid those fees as I kept asking Wachovia what to do and there was nothing they could do to help me. The money is now in collection and has been put on my credit. I'm unsure if what they have done to me is even legal..Any advice?

We became 3 months behind on our business loan with BofA. We have been customers of BofA since 1987. Without a warning they ZERO'ed out our checking account $ 5978.21--wiped us out. We had been struggling to keep up with payments and also had a debt consolidating firm assisting us. This was devastating, financially. It was immpossible to get someone one the phone(in our panic) and then were told debt offset. We feel this was an unauthorized debit--STOLEN FROM US--with no one would reverse. (we would have paid the 3 month back debt...)This completely broke our trust in this firm.
All our monthly automatic withdrawals bounced--adding further to our economic hardship--rent payment was not there, as well as the monthly allowances for food, gas, transportation, medications, etc.

I was flat broke, I stopped using my bank account at Wachovia Bank. I had 0 Balance. I told the bank to avoid any overdraft fees please do not pay any automatic debit that might be billed. Mainly I have a lot of services online that might end up rebilling that I may have forgotten about. They agreed and had it on my file.
I recently received a letter from them telling me my account was -$110 . I immediate called and asked them what bills the paid and why? The said they didn't pay any bills but a domain company that I bought a domain from 5 years ago automatically tried to renew the domain and retried 3 time after they declined payment. BUT The still charged me every time for insufficient funds fees each time. resulting in the -$110 balance.
So Not only am I am broke . My bank is charging me because I am broke whether or not the paid anything. How is this fair? They told me I should have closed the account . But I need it just in case ,instead of cashing my paycheck for bills I could deposit some money. But Wachovia didn't care the think because they were asked (but didn't pay) they should charge me a fee. Is this fair? My bank making me more broke? STAY AWAY FROM WACHOVIA BANK!!!
Now they are suing me for the fees and reported me to some agency to make it difficult to open another bank account.

I borrowed 15,000.00 in a school loan from a reputable bank (NOT Bank of America) and it was addressed to myself and my grandfather (co-signer). As I have been depositing large amounts for the last few years as my school loan checks come in I did not worry about depositing my 15,000.00 check into the ATM. This was a big mistake! Because this particular check was addressed to myself AND my grandfather they said they could not accept it. However, this was after they put the full 15,000.00 into my account which I saw through my online banking webpage the day following the deposit and I started writing checks to pay tuition, rent, etc. This amount was not in the pending section it was in my account, all 15,000.00.
Therefore, I wrote all these checks and was using my debit card only to find out a week later that had pulled the whole 15,000.00 check out and began docking me 25.00 overdraft fees and then 35.00 overdraft fees, and then 35.00 NSF fees for all my checks that began to bounce. In the mean time I had just closed my campus mailbox where BofA was sending all my banking mail (and lots of other things were being sent there also) and was in the process of updating my address with all of these companies. So when BofA went to return the check, they sent it to my closed campus mailbox thus leaving me with no choice but to wait for my check to make its way back through the post office so I could add my grandfather's name to my account and get that check deposited back into my account.
Okay, what my problem with BofA is: They put the whole 15,000.00 into my account leading me to believe that I was safe to write checks and pay my bills with my student loan check and then later that day they took the full amoutn out without notifying me directly. If they discover that one or more of the payees of a check isn't on the account after they have deposited the check in full amount into your account, they need to notify you directly not through snail mail which in my case got sent to a closed campus box leading me to accrue unnecessary bank fees.
To date, BofA has charged me 511.00 in both overdraft fees and NSF check refund fees. I spoke with Charles Lee at the Alta Loma brach where I originally opened my account four years ago and he assured me these fees would be taken off. He gave me a card with a Customer Solutions Center's phone number on it and told me to call and they would take care of the fees. He even said he put a note into the system about me calling. However, upon calling today the Customer Solutions representative I spoke to refused to refund the fees and when I asked to speak to his manager he would not let me stating, This is the highest your call can be escalted to. I have since tried to contact Mr. Lee but surprise, surprise the number he gave me to reach him is out of service.
Because of Bank of America's hugely unfriendly staff, unhelpful customer service representatives, and poor communication with me I have had to go 2 whole weeks without any money, use 511.00 of my school loan money to pay BofA fees, wait two weeks for the check they sent to my closed campus box to make its way back to me when I would have come to the branch to pick it up had they called me (you know, it being such a large amount), I had my school threaten to kick me from my summer school courses because the check I had originally wrote them after double checking that the money was in my account bounced, and my reputation is ruined with them. In addition, my grandfather has had to take off of work just to come to the bank with me to put his name on my account and because they treated me with such little respect I had to bring an older man just to get them to give me any real answers. Answers that in the end, got me nowhere.

I made some purchases (3) with my debit card (actually entered my pin) and that is basically like going to the ATM...the money is deducted from your account right then and there! Well, I used my debit card, thinking the money had already been deducted, I made two additional purchases two days later. The day after that I go to use my debit card and it gets denied. I am thinking "no." "I have funds available." I go online to check and see that I have 5 NSF fees!
I called Wachovia and the representative said that when even though the purchase was made on a certain day that it did not come through to Wachovia until 2 to 3 days later! That is a bunch of [lies]! I told the rep. that the card I used was my debit and when you use a debit it is just like using the ATM, so the money comes out right then! The Wachovia rep. just repeated the same crap over to me again. Later I get my statement and see that the debit transactions are actually listed as posting days later, but on my purchase receipts the purchase date is 2 to 3 days before!
Now, I can see a transaction posting that late if a credit card is used because of processing time; however NOT with a debit card! The money should automatically be deducted when the purchase is made. What Wachovia does is they have the debits set to purposely post late, so that people will continue to make debit purchases thinking they have money available. Wachovia practices are unethical and they should be reprimanded for such unacceptable practices. They basically stole money from me. I work hard for my money and I ended up having to pay NSF fees to other business as a result of Wachovia's greed.

These guys charged me four hundred and fifty-eight dollars in overdraft fees. I thought I had 1.50 in the bank when I made a two hundred dollar deposit. Essentially, what did happen, was I was charged overdraft fees on transactions in my account when those same transactions showed up in the black on online banking after making a two hundred dollar deposit a week before the two hundred dollar deposit already referenced above. Given that I can count to two hundred and I thought I had two hundred in my account I spent it, unaware that I had three fees charged to earlier overdrafts that originally showed up in the black on my account the previous day. My spending two hundred, while I actually had 95.00 dollars after they charged the fees, I ended up with more overdrafts. I got some action after complaining relentlessly.
Iif I continue to bank at BOA, I am self diagonosing me as officially out of my mind. Therefore I'm closing my account today.

I have a joint CITI credit card with my aunt. Citi sends me checks to do with what I want. The credit limit is $28,000+ with a cash advance limit of $15,000. This account has been perfect for 4 years. As I needed funds I would deposit these checks from a stub pad. The stub had the date of expiration but not the check. One time I realized I deposited a check with the expiration expired. Citi cashed it and said I had this opportunity till the end of 2008. When I received the next batch of checks I was going to make a deposit so I removed the check from the dated stub. But I didn't use it then. A couple of weeks later I needed funds and used the check I had removed from the stub pad. I deposited the check and the next day withdrew the funds. Unnotified to either me or the primary cosigner Citi refused the outdated check. Now my record will indicate I have done this numerous times before and almost always withdrew the funds the next day. It's common sense, when your take advances you need the money so why is it fraud to remove it right away.
So BofA closed my account but oddly accepted a wire transfer from the same institution that previously denied to cash my check. Now BofA has me on chex systems and is in possession of my $600 wire @ over 20% interest since May 9 2008 and I have no access to funds I must repay at a high interest rate.Now I receive a statement from BofA that I got debitted $35 for a bounced check and $60 for account review. BofA asked me to confirm by notary that my cosigner of the Citicard knew of my transactions. My aunt did so immediately and verified that I have full authorithy to do as I wish. This was faxed with receipt on May 9 2008. After countless follow ups all I get is rude hangups or it's under review. What is to review. I proved it's no fraud and have a history of these transactions. All this happened because I mistakenly depostited an advance check that was expired and these checks have no expiration date only the stub does.
Now I am barred from opening amy account because BofA reported fraud to chexsystems. My cosigner who by notary confirmed she was aware and consented to my transactions was rudely hungup on by the agency that requested proof that no fraud was committed. Without a checking account I now must use money orders at a cost to me and not have access to direct deposit of my income pay. I don't blame suspicion by BofA but I have given them all they asked for to clear my name. Why didn't BofA contact me via my cell they have my number. Why wasn't my cosigner contacted via Citi?
Cost of money orders, delayed access to biweekly pay because of no account for direct depsoit. Loss of $100 for opening chase account with direct deposit due to chexsystems. Telephone correspondance waiting on hold for countless minutes while being rudely hungup on. The cost of my wire advance of $600 since 5/09/2008 without access and the cost of $60 review. My gas to go to differebt branches of BofA and time off from work. My emotionly state has caused depression, my erratic behavior by missing work almost to lose my job. My nerves have tensed everytime I see a BofA ad or branch. I have lost hours of sleep trying to figure out how to resolve my conviction and sentence by BofA without a trial.

I talked to a representative concerning my account because I had been charged a $105 in NSF fees. She informed me that Wachovia pays the highest amount first and then the lowest amount, regardless of what comes in first. I must say that the representative was very nice but as I begin to question her about this practice her responses became somewhat shaky.
I firmly believe that credits should post first and then debits should post as they come in. Wachovia should not have the right to decide what is paid first.
As a result of this practice, I paid a $105 in fees.

My husband has been with Wachovia since he was 18 at which time it was First Union and was eventually bought out by Wachovia and he kept his account with them and had fairly decent service for the next 9 or 10 years. However for the last 3 years we have had the worst experience possible with them. We have had our check card numbers stolen and large sums of money charged to our accounts and when we call they tell us there is nothing they can do until it posts to the bank so I then have to do the leg work and get the transactions canceled and file charges.
I have also asked repeatedly for both mine and my husband check cards to be canceled to avoid this happening further only to call the next day and find out they weren't closed. It finally ended up that 3 days later my husband who is in Iraq had to call them and argue with them to cancel the cards and issue new one which we don't even want because we are leaving the bank for another that is more reliable. We also have overdraft protection on our account which never seems to work and we always get charged NSF fees that we then have to call and argue about until we finally get them back.
Today I was looking at the account and noticed some strange charges so I called and the lady told me I disputed something in April and never responded so she gives me the information for the company and tells me I need to call them so I do so and they have no record of a charge ever being made. So of course I called back and the lady looks into it further and finds out some stupid dispute investigator charged the money to the wrong account so her supervisor gives me my money back after and hour of aggravation and trying to figure out what was going on.
I really don't understand how a professional corporation can make as many mistakes as they do. I really do believe that they love to scam there customers to make money. Luckily we got all of our money back and are now waiting for all of our now in the process of transferring our money to a different bank.

On Jan. 15, 2008, I opened a free checking account with Wachovia Bank (#1010192166692) and then on March 20, 2008, I opened a savings account, also with Wachovia Bank (same branch) (#3000112166790). I CLEARLY stated to the officer establishing said savings account that under no circumstances do I want the two accounts to be linked as I cannot keep track of constant transfers from one account to the other and vice versa. He said that was fine.
On May 5th, 2008, they transferred $196.37 from my savings account to my checking account without my knowlege or authorization! I physically went into the branch to deposit an additional $1000.00 to cover the overdraft that I thought had not yet been taken care of. Had I known they were going to transfer funds to cover it, I would have not gone in and thrown another $1000.00! I am an unemployed single mother desperately trying to save thousands of dollars to move my child and myself back to California as things are no better here in Georgia as they are in any other state in the union and we'd rather be home.
am FURIOUS that they not only transferred my moving money when they weren't supposed to be doing that AND still charged me hundreds in NSF fees! They cannot have it both ways! This should be considered theft and illegal! NEVER AGAIN will I ever in my lifetime open both a checking and savings accounts with the same banking institution! Banks view this as invitation to do whatever they chose with my money regardless of how my accounts are set up!
This is both ridiculous, highway robbery and I will not tolerate it! What good is a Customer Service Dept. when all you get is lip-service and the run-around with no positive outcome of your complaint. I suppose this is where you guys come in. They should all be dissolved - banks! They are all thiefs! I will now have to stay here in awful Georgia for another full month, miserable in this heat and my current living situation where we are being abused every moment of everyday. This is causing me emotional and mental distress! Wachovia will transfer my funds in the amount of $196.37 back into my savings account and will reverse all NSF charges incurred since the date this account was opened in January 2008.
Once I receive a phone call from a bank manager advising the above has been done, I will go into my branch and close both accounts! I will never again put so much as one single dime into Wachovia and will insure nobody I know will either. Matter of fact, I will no longer use banks. I am hereby boycotting them all. I will simply have my mother cash my checks at her bank and use .50 money orders from Seven Eleven or Am/Pm mini markets to pay my few bills each month and will keep my cash at home in a fire proof safe. I have had two problems with BofA. The first happened when I was young. I joined the military and was required to set up direct deposit. I opened an account with BofA. While I was out in the field in NJ for training my account was emptied. I called the bank a couple weeks later when I got back in and they told me I had taken the money out. I explained that I was the only one with access and that it was impossible because I was in the mountains training at that time. They never gave me back over $700.00. That was almost a months pay for me.
The next thing happened when I moved to Michigan. I closed my BofA account because we did not have them here (now they have bought out LaSalle bank which is the worst bank on the face of the Earth). I was negative $84.00 in the account so they told me to send a money order to cover that. I did that immediately. They received it, signed for it and posted it. They even sent me paperwork showing my account closed. Which is why I was surprised to find it on my credit report as a negative hit. They said I owed them money. It also showed on my Chexsystems.
I, like everyone else on here, called them and called them to no avail. They don't care and continue to report on my credit report. Couple that with shady credit reporting agencies who don't remove false info even with proper proof, and you have one huge mess that only hurts us. Nobody seems to care about the consumer and how it affects us and our lives. I can't even open a bank account because of these people.

My son and I have a checking account together, we opened it in 2004, we also had a truck loan with this bank which we recently paid off in the amount of $8,000.00 Know that this is a small town maybe 8,000 people my son was born and raised her we have lived here for 30 years everyoine know who we are and that we are not going anywhere and that we are hard workers and pay our bills..so..we deposited a $2,800.00 by ATM on a Sun. afternoon a receipt came out and told us the balance in our account was 3,400.00 we then withdrew $100 cash a receipt came out and told us we now had $3300.00
two days later we paid some bills eleven all told those checks were returned NSF, not sufficent funds, why we asked the banker oh he said a hold had been placed on that check why we asked the banker, well he said you have been overdrawn several times..why weren't we notified we asked well he said when you opened the account, 4 years ago, they told you banking policies, I don't think so and where is the customer relations pick up the phone NSF was a lie the money was in the bank
the bank charged our account $385.00 in NSF and every check that was returned that business charged $30.00 another $300.00 and now our reputation is skeptical

I was charged 5 overdraft fees of $35 each on 5/19/08. My account was overdrawn by $6.81 by their own records on that date. The way they stacked the charges, the last two of $15 & $4 overdrew the account by the $6.81. I have not disputed the $70 in fees. However, many customer service reps and a phone supervisor later, we are still going around and around over 3 charges which left the account still at a positive balance. They claim that another automated charge caused it - but yet that charge went in 2 days later- causing it's own fees. How can I be charged 3 x $35 for charges they show leaving a positive account?
$105 extra in overdraft fees.

I had ZERO balance but they refuse to close the account and keep charging me (50 dollars ) for not using the account and then pile up late charges on that. Is this a fraud or pure plain incompetence? Why should I pay late fee charges on a a charge of not using the account when I wanted to close the account and they refuse to close it? Very frustrating. Maybe they do it for a lot of other people too.

I am complaining about the way that Bank of America's (BOA)accounting practices. I have a fixed income that is a direct deposit to BOA monthly. When my balance gets low, they will rearrange the incoming transactions and place the larger ones in from so that my account will go into the negative. Then they do not pay the check but at first glance make it look as though the check is being paid. When you go to view the screen again the transactions have been completely rearranged and your balances are different again. This is a way for them the rack up on a lot of extra fees.
They also will hold transactions and not post them until your balance is low and you wonder where the transaction came from. Sometimes the transaction is over three weeks old. I want nothing to do with their banking system and I am in the process of changing to another bank.

Even the Amount Availabble information box in the left screen indicates the full amount, an amount the would make charging a $35 dollar overdraft fee impossible. They also indicated that they post the largest transactions for debit first making, in our case, 7 different $35 dollar overdraft amount. Please remember, there was plenty of money to cover all transactions in all boxes, even the amount available.
Over $500 dollars in bushwacked overdraft when plenty of our money was in their bank and all indicators of theirs said so also.

I took care of my mother while she was ill, before she passed away. We filed a Limited Power of Attorney with Wachovia, so I could sign her checks and deal with the bank on her behalf. When she died, Social Security pulled the money that they had paid her for that month out of the bank. She had already paid her bills, so this put her account in arrears. Wachovia then took the money out of my account to settle hers, putting my account in arrears. I found out when I went to get money to live on.
I went to the bank and spoke to the manager, explaining that the Limited Power of Attorney that we had filed did not make me responsible for my mother's account. The manager told me, That doesn't matter, they won't give you your money back. She was right! I called and talked to several different people, and they refused to refund the money that they basically stole from me. As it wasn't an extremely large sum, it wasn't worth the cost or time of hiring an attorney.
I was left with no money to live on. I was moving back to NY and had a friend there with a trailer to move my stuff. I went to the bank to get money to pay for the fuel, and no money.

On January 18th 2008 my bankruptcy was discharged. I was then told on the phone by two senior customer service reps that I did not have to pay my loan, so I asked them to send me letters stating that. I received one letter March 12th 2008 and another March 31st 2008. The Chapter 07 bankruptcy was filed on 10/05/07, discharged on 01/18/08 and closed on 01/23/08.
I just received a letter on May 8th 2008 notifying me that Im four months and a total of $5,813.00 behind. Bank of America is now stating I need to pay to avoid repossession of my house. Im told by a representative of Bank of America that their standard answer to everyone is You do not have to repay the loan.
Bank of America told me It was include in my bankruptcy and I didnt have to repay the loan. They also failed to mention that they would repossess my house four months ago . Bank of America gave me the wrong information and should be responsible to fix the problem they caused. I dont know what to do at this point and Im afraid Im going to lose my house. Please help.

This all started when I was doing some shopping and wanted to place a purchase on my BOA debit card. It was declined time after time. This was rather embarrassing being put in that situation for the first time and surely raised some red flags. I stormed back to the office to go online to check my account for any fraudulent activity, know noticeable at that time.
Then I recalled receiving an email from BOA back in 11-5-07 regarding Irregular Check Card Activity, I call that number on the 1.877 on that email and after the long wait I spoke with a rep and he couldn't seem to help get to the bottom of the problem for total satisfaction. I asked to speak to a SUPERVISOR, "what a disgruntling mistake that was" as he connected me with Jodie. I was complete shock by such a poor lack of knowledge she displayed along with a very poor attitude
and furthermore the inconsistent info that was given from her side. She told me my card had been compromised and said that my card had been blocked, which was the only consistent info that was pass on.
So pls don't get me wrong, I do appreciate BOA detecting any and all possible threats of compromising and or ID threat to the utmost! But Jodie's poor attitude and lack of consideration after she had mentioned she's been in the business for 9yrs surely doesn't reflect on a competent level, not unless she has become so complacent that she thinks she can just treat customers any way she pleases and get away with it like she unassailable and irreplaceable.
I'm over in Kuwait working with the DoD and due to the nature of my job I only have a APO military mailing address and she wasn't consistent nor able to execute any level of brain storming to keep me at ease. I had to tell her about certain programs BOA offers after she said she can't FedEx my card to my military APO address, and went on to tell me to get another address whereby she can arrange the card to be sent via FedEx. I call FedEx Kuwait and got the address and then called back and spoke with her so called assistant SUPERVISOR, after the long wait. She had the say drawn up attitude parallel with Jodie which became even more shocking and disgruntling. Then I really had to ask myself do I really what and institute like this that hires these sort of reps/SUPERVISORS to handle my money without the proper training with extremely poor customer service!
I am pretty sure these phone calls were recorded for all of the facts. I am very irate so pls get in touch with the proper management for proper counseling. I will be in the states very soon and I would appreciate it if I could get some feed back on the disgruntling issue that could probably convience me to stay with BOA.

Reason for Disputing: Wachovia has misrepresented the state of my Prime Equity Line account. They recorded my routing/draft number incorrectly. After investigation May 19, at the Falls Branch, Raleigh, NC the research uncovered they had my account number minus the 05 suffix which signifies checking. Their error and failure to correct accurate information has caused no payment received for the March, April and May and a negative hit on my credit, and fees and charges.
I verified my bank numbers and had continuously tried to work with Wachovia the past few months but the problems persisted with complete incompetence. Their conduct has been immoral unethical and unscrupulous, their failure to correct my information after being repeatedly being asked, is a deceptive practice.
I requested an address change, my account statements, posted checks, and payments and at the end my closing papers, it took several requests over months for these request to be honored and their failure to disclose material information resulted in more time passing for Wachovia to try and collect late fees and make my account appear more outstanding. Even sending me a FORECLOSURE letter certified mail! This has caused me defamation, and a lot of infliction of emotional stress, I have had hives and can not sleep because of this unresolved issues keeping me awake.
My first mortgage has drafted from Wachovia for over 6 years with no problems. This had gone on too long; I felt my only recourse was to pay the full amount $24,000 and close the account completely and dispute their findings. I have all the supporting information and am disputing it with the credit agencies as well as Wachovia and turned to the BBB and the Attorney Generals Office of NC.
Lack of sleep, frustration, hate mail and phone calls and fees and charges and 30 and 60 day late hit to my credit history. A Certified mail of Intent to Foreclose for the min payment of 311.17.

They cashed one large check so they could charge me a separate over draft fee for several very small checks. The total amount for $50 in checks was $300 in overdraft fees. That's six times the amount of the original checks! Now they are threatening me with a collection agency!
I had to withdraw what money I had left and now stand to have my credit damaged by this bank. This should be criminal.

My wife's mother died in January 2007. She had a Wachovia Cap Account, including checking, stocks, savings, safety deposit box, charge card, etc. My wife was the Successor Trustee and we went to Wachovia to have everything transferred into her name. It took months. (I finally threatened the securities manager with an SEC complaint if he didn't get the name transfer within 48 hours). Guess what? It was done! Then, out of vindictiveness they froze the trustee checking account and caused several inheritance checks to nieces and nephews to bounce! What an awful thing to do!
I went to a local branch and told them I wanted to close out the charge card and pay the remaining balance. They checked with the head office, told me the amount due and we paid it. After that, they started billing us for an unknown old $178 charge that they wouldn't identify, and we responded that we had closed the account and paid the balance that they stated. We contacted everybody in Wachovia, from local managers to the head office and we were told it would be taken care of.
Months later, here it came again, this time with late fees and penalties tacked on, for a total of almost $400. I kept writing that if they couldn't, or wouldn't identify the charge, it was not our responsibility, especially since we had closed the account and paid the balance. Wachovia then sent it to a collection agency, which worried us with respect to our excellent credit rating. I discussed the entire thing with the collection agency, sent them an 18-page fax with all the details and correspondence, and they agreed with us and recommended that Wachovia drop the case. Wachovia refused to drop it. I offered to negotiate a settlement just to get rid of the mental anguish. and Wachovia refused my offer of 50%, and insisted on almost the entire amount. We reluctantly paid it, just to get it over with, but still feel like we've been screwed over by Wachovia. These examples are just the tip of iceberg of what Wachovia has done to us.
We paid the balance of the charge card, then were billed for almost $400 more! Over a year of frustration, harraassment, letter writing, and phone calls....all amid the grief of losing a loved one. Both my wife's health and mine have taken a serious turn because of it, We are in our 70's. We have both been in the hospital for observation for heart problems. (My wife twice)

On 05-09-08 I orderd a stop payment on a check that I wrote completely wrong due to being in a rush that day. A few days after the transaction, the individual that i wrote the check to changed the terms of the service That I did not agree to and I decided to cancel the check. I dont understand how this individual managed to cash a check that had two different amounts on the check($100 in text and $168 in digit box)and still managed to cash the check for another amount($160)that was not written no where on the check.
When I saw the check clear I immediatly called customer service and explained my situation on 05-12-08. They heard me out and stated in a recorded call and that they understood my situation and said they would reimburse me for full amount in 24 hours. 05-15-2008. they did not reimburse for anything so i made another call to customer service this time they bombarded me with legal bank jargon and telling me to put myself in there position and to except a $60.00 reimbursment.
After a 30 min discussion about how I messed up in writting the check and how when processing my stop payment I should of stated the legal amount which is the amount you wright in text (silly me, I thought everything you wrote on a check was LEGAL). This still does not explain the negligence of BANK OF AMERICA cashing a check for amounts not written on check. What to stop them from confusing two zeros from three zeroes and blaming customers for there mistakes. On top of this whole mess The supervisor(daisy Employee#1580)decides to starts making snide remarks and when I asked to speak to manager she transfers me to some random employee's mail box. Any information to help me resolve this matter will help. Thank you.
I have not been able to pay important bills due to there mishandling of this matter.

A few years ago I financed my mortgage with Wachovia, at that time I had a fixed rate with an adjustable to begin in 5 years. My intent was to refinance and get a fixed rate before the adjustable took place. Due to unforseen circumstances that was not possible. So my payment went up 165.00 a month.
That is not my complaint, my mortgage fell behind and it is hard for me to come up with all the money at once so I started paying 230.00 a week. After doing this for seveal months I could not understand why my interest and late fees never looked like they were going down (that amount was more than 150.00 over my payment amount). I received a call asking me what my intentions were. I explained (like I had at least once a week) that I had 230.00 a week drafted from my account and I didn't understand why the amount didn't seem to be changing.
The representative that I spoke with told me (first one out of MANY) that they hold my payments in a special account until I have enough to make a payment. They were not applying the money I was paying toward my account. so late fees and daily interest was still racking up. I have sinced stopped those payments and I plan on holding my own money until I get the payment up.

Their rules constantly change to benefit their pockets and there is no consistency from one rep to another. In the past year, they have managed to rob me of over $900 of my hard earned money. I only know this figure because it was thrown in my face today by a so-called customer service manager that Im doing a poor job of managing my finances. Never mind the fact that I'm a single mom and a business owner trying to keep my head above water in the mortgage industry. I have been monitoring my account on-line constantly to prevent this from happening, and no one could offer me an explanation, all I know is that in 5 minutes I racked up $210 in overdraft fees for $30 worth of transactions.
When I questioned why they process transactions from biggest to smallest instead of in the order they are presented, I was told that this was intended to benefit the consumer so the most important items are paid. OK, so if I have a $100 light bill and I go on a shopping spree for $110, how is it more important to pay the shopping spree first? They have no method as to how long credit transactions and debits show as pending before that money is out back into your balance. All they can tell you is to write down every time you use your card, and do not rely on the online banking as a ledger. I may be wrong, but I thought debit cards were created as a convenience to the consumer, and on-line accounts were an added convenience. If I have to write down each time I use my debit card, wouldn't it be easier to write checks and have carbon copes so I can transfer it to a ledger when I have time?
Their customer service reps are rude and have no clue what they are talking about. They just love to point out that it's your fault and they stick together like glue no matter how wrong they are. Bank of America is definitely an institution with no heart. If anyone knows of a class action lawsuit against them, I would love to voice my opinions.

Wachovia bank is in the habit of charging NSF fees for account regardless of whether you have the funds in your account. Over the past two months, they have charged in excess of $500 in NSF fees to my account. During the period of these fees, I had sufficient funds in the account. They stated that the funds were not available. The deposits were withdrawn from the cooresponding bank. Wachovia seems to be in the habit of makin money by charging fee.
I have had to pay in excess of $800 for NSF fees to Wachovia. In addition, I have had to pay $300 to the vendors and employees to cover their bounced check fees.

I was refunded money for a purchase. That came up. However I was charged $210 in fees for transactions that were held. I know I should have been more diligent with keeping up my register but this isn't the first time I've had a problem with this bank. I'm still sorting that out. I've tried talking to them but I get no where. It's frustrating. I know that banks need to make money too but I feel like I'm keeping them in business. I've even had a customer service representative from Wachovia tell me that they also had overdraft issues with them. How sad is that? I'm done doling out my money.
I've had problems off and on with them for almost 3 years. I have had so many fees taken out and am still paying for their policies. I had written a check for over $500. I had the money in my account and deposited a check for the $500 that was owed to me by my stepfather. They decided to hold that check therefore causing every other purchase and check I'd written to bounce. I had the states attorney file charges against me for writing bad checks. I didn't write a bad check. They decided to hold it causing more harm. I've spoken with the attorney and he said unfortunately they are allowed to do that.

I live on my disability income of $884.00 per month. The amount is directly deposited into my Bank of America account the third of each month. I have written, emailed and called the bank to tell them to cease and desist their over-draft protection several times. It has not stopped. I spoke to a supervisor today, May 12, 2008, and asked for it to stop. He told me it would. I have been told this before.
I have paid out $1716.00 in overdraft fees to Bank of America over the past year as a result of their protection. These fees have come directly out of my only source of income, my SSD check. Each month I start out in a deficit as a result of these $35.00 fees. They have charged me 5 times for one check! They will not credit my account for any of the overdraft fees even though I've told them to stop in writing. At this point I can't close my account because of being overdrawn. Do I have any recourse?

Bank of America indadvertantly charged 4 overdrafts on our small business acount that had $598.27 on balance. No one at the bank could explain why. When asked to correct the problem and reimburse our account,it took 2 days to get a response. since it was not fixed immediatly, more overdrafts occured due to the first four reducing our balance by $140.00.
they fixed 6 of the overdrafts, leaving 7 more that they would not fix. The bank resident said thats all they could do and never gave an explanation as to why this happened in the first place. They,did not know why this occured, but thats all their gonna do. The bank president was not willing to find and fix or explain the problem. We have done business with this bank for years and now we can't een get an explanation as to why these accounting problems are happening.
Besides losing money to this fradulent way ofdoing business, it has caused distress to my wife since it directly effects her small business account. Being treated rudely has its own effects resulting in more distress.

I did a little shopping over the weekend, took my family out to lunch, got gas, and paid a bill. I deposited the amount of money I thought I needed to cover all of my expenses. I looked at my account online on Monday to make sure I still had enough to pay another bill. It was there so I paid it. Unfortunately, I also had an automatic debit that I had forgotten about, taking away 15 dollars I needed to cover that last bill.
On Wednesday, I checked my account and discovered a charge for $245.00 for unavailable funds. Shocked that it was 245 and not 35 or 70, I called customer service. They told me that they paid that last bill, but had to charge me for each transaction I made over the weekend in order to pay the bill. (In reality, those other charges should have been paid first, then I should have been charged only 70 in fees for the bill and another 5 dollar transaction that day.)
So, I had to borrow money to bring my account back into the positive since I had insurance to pay and my paycheck was only enough to either cover insurance or the negative balance-not both. Cash was deposited into my account the evening of 5/8/08 to be available on 5/9/08. Friday morning at 11 am the money was available. Friday evening at 5 pm there was no record that the deposit ever happened. Saturday afternoon, the deposit magically reappears stating it would be available on Monday, however now I have more fees being assessed for transactions that happened before I discovered the deposit went missing.
To top it off, the bill they had taken the money to pay that resulted in the first seven charges posted friday...with a 35 NSF fee. How can I get charged a fee for something that was supposedly paid? If it really hadn't been paid, then those first seven charges would not have been justifiable. So I think that I should owe either the 245 for the seven fees because the bill got paid, or 35 for the bill that wouldn't have had ALL the money available because the seven transactions went through first.
I am now out over 300 dollars that should have been available to make a car payment and buy my son's medication. I am a single mother of three with a handicapped son. I do not have a lot of money to spare and when I am charged hundreds of dollars unnecessarily, it is hard to catch up, pay back the negative amount, and feed my children.

After promising me three times that I had overdraft protection on my checking account, with my American Express card, I was charged $35.00 per item, that cost $2.00 to $3.00, instead of having the promised protection kick in $25.00, which would have resulted in only one $10.00 bank charge.
On top of that, I was charged another $115.00 with no reason. I lost that money, and decided to close my account and cut my losses quietly. Today I received a letter informing me that I owed $140.00 for over a month on this closed account. I was told at the Bonney Lake Branch that there would be no charges to me and the account was shown to be zeroed out. I was told I would get a receipt but then later told I didn't need one. Will this account closure stick?? More to follow. I'm skeptical.
Over 100.00 in overdraft charges.

the customer service at Bank of America is horrible. I called over a week ago to have one of my debit cards deactivated because my ex-boyfriend had access to it. I spent 15 mins on the phone with the rep who told me he had deactivated the card and that I could cut it up. Needless to say a week later my ex went to an ATM and toom money from my account. Of course when I called Bank of America's customer service they didnt have a record of me asking to have my card deactivated.
Luckiely it only resulted in my losing $62 dollars. however, it should have never happen if they would have done as I asked them.

As of today I am overdrawn $274.00 -- and the bank in the last two days has charged me $150 & $120 in overdrawn fees -- $270.00 for fees which they approved at the time they were processed. Without these fees -- I am overdrawn $4 and some change -- so how can I be charged for NINE transactions. It just doesn't make any sense -- and they refuse to do anything more than state the same crap over and over again. They did advise that I opt out of a feature that allows them to approve transactions when I don't have the money to cover them. Why would I want that in the first place -- and they tell me I'm opted in automatically unless I opt out. Does that make sense in any galaxy? It sure doesn't in my world.

To make an extremley long story short, I have found this bank to withhold certain transactions in order to collect on NSF fees. This particular account I speak of is the account my husband and I use as our frivolous account where gas expenses and other unimportant purchases. I have every issue I have had and who I spoke with in writing and its always the same issue, they like to wait to post the debited amounts. I stringently keep a registry as well as my husband and we compare and are maybe 50 cents at a time off from each other if that, so you tell me how two seperate people are getting similar amounts and none in the negative, we work hard for our money and di not appreciate money stolen from us.
This unstable environment is the reason we did not invest our 45000 from wedding gift in this bank. It was just closer to our home. I hope you can help us break through this trend of greed. Thank you

An online payment was made to the electric company for $207.00 on May 1st that they say I authorized. I did not. Only one person I spoke to Jeanie Keeton, said the bank made a mistake and then she sent me to the dispute department, they sent me back to my bank,who spoke with the online rep., they said I authorized this payment. They said that even if the electric company gave me back the $207.00 they the bank would not credit me for the overdrafts that this has caused.
This has now made my account over $400.00 in the negative. Causing financial hardship.

Last week I called Wachovia to close my checking account. Today I checked the status online and it was still open. My husband had paid off the attached overdraft account, but instead of a credit I saw a payment to the account which had previously been paid and was not due. It had also been deducted before it would have been due if it had not previously been paid. I called Customer Service at Wachovia and they corrected the online overdraft account to reflect the payoff and credit the erroneous payment back to the account. I then inquired as to the status of the checking account closing. They said there was no record of the request. I then requested they close both the checking account and the overdraft protection account. They informed me I will not receive the credit balance in either account for two to three weeks.
This is similar to their onerous practice, where if I deposit funds on Friday after 4:00 p.m. the amount is not available until the following Tuesday. Although I paid a monthly fee to keep my small checking account open, they tell me I will not receive any interest for the period between the account closing and the return of my remaining funds because I don't have an interest bearing account. What are they doing with my money during the interim? Short-term cash investing, of course. They don't allow the customer a margin of error and yet we are literally giving them our money to do with as they choose until they deem it ours again. Where are the profits from these transactions going?
It is all over the news of late how Wachovia has major 1Q losses, is under investigation for money laundering, etc. I realize this is not as dramatic as a house foreclosure, but it is disturbing. When viewed across the vast customer base Wachovia has, it is clear they must make a sizable profit from the short-term investment of their customer's cash and fees generated from rules no one would consider fair.
I have had my account with Wachovia for many years. I have paid fees for my account. I am loosing the access to my money now and have in the past. Total loss of funds is unknown, but a sizeable amount given the length of time I have had an account with the bank.

Bank of America-- Predatory Banking! I have been a loyal BofA customer for more than 2 decades-it must be $ millions in transactions. All my personal finances and my families business transactions. My entire customer worth came down to a dispute with a net value of $140 dollars in unfair overage fees. At the time of my initial request, I called and spoke to several representatives who assured me that a savings account was closed and that the money had been transfered to my checking account.
I also requested that this little scam keep the change be closed on my account. (in effect, this actually was the reason that they were not able to close the savings account...or so they claim) Neither of these two things happen and I was subsequently charged 5 overdraft fees of $35 each--independent of the fact that this would be more than covered with the savings amounts that should have remained in my checking account.
I will close my account today and go with WaMu or Wells Fargo, who don't have these charges. I simply cannot BELIEVE this crap and will take all my business elsewhere. I am willing to serve as a spokesperson against BofA as they (in the name of profit) have so eagerly/readily dismissed by business.
Consequences to me-- multiple $35 charges, stress, overage fees, wasted business hours, and overall lack of respect for a long-term client.

As of today, 5/6/08, Wachovia Bank has yet again stolen hundreds of my hard earned money. They cashed a check that I had written to a friend hours before I made a $300 deposit. Instead of refusing the check due to insufficient funds and telling her to come back, Wachovia clears the check and THEN clears several debit card transactions and ATM withdrawals from 3 -4 days earlier! These transactions had already shown up on my on-line banking statement the day before and that money was no longer available to me. But suddenly this $200 check was cleared by a teller BEFORE transactions from the weekend before throwing my account into the negative and charging me $350 in overdraft fees.
To top it all off, I deposited a $300 check into my account on the same day that all of these transactions so called bounced but this money has still not been credited to my account. This deposit would have covered everything including the $200 check. The deposit is even from a Wachovia Business Account so all the teller has to do is verify the funds are available and credit it to my account to prevent the account from overdrawing. But that would cut into their bottom line wouldn't it? Where else are they going to make all of their non-interest fee income if not for stealing their customers' money. I'm so mad I don't know what to do. I can't pay rent, my car payment or put gas in my truck to finish off the work week because of these thieves. I would like to know if there is a way to file a Class Action lawsuit against this deviant corporation.
I will now be charged a late fee on my rent and car payment due to the theft of my money. Wachovia Bank is a prime example of a greedy corporation who will do anything to their customers in order to pad their bottom line. The consumer abuse this company gets away with is disgusting.

Just another Wachovia customer who apparently can't manage their checking account. However, I think I have you all beat......my husband and I opened a checking account when we moved here 6 MONTHS ago. And since then have been charged (hang onto your hats) $8,559.00 in OVERDRAFT FEES! Of which they have refunded $358? I smell another class action lawsuit headed in their direction. They've already had to pay out on their telemarkting practices.

My Husband Brian and I went to the above location to return a Chevy Trailblazer that was financed through them because my Husband had been laid-off, a woman came into a room and asked us why we can no longer make the payments, I explained to her the reasons she proceeded to say that we would be sued that they cannot accept the car that we had to wait for it to be picked up from our house.
I got mad and said look lady I dont want the car I can't pay for it and we argued she looked at my husband and said I am sorry you are married to and have to go home with this lady. I am sorry that we could no longer pay the loan but I do not see how slandering my character has anything to do with how business should be conducted.

To all of you guys out there that have been shafted by Wachovia Bank or Wachovia Mortgage, file a complaint. From the OCC site "The OCC's Customer Assistance Group is ready to help customers of national banks with questions or complaints they have about their financial institution." I was repeatedly contacting Wachovia with no response, Wachovia did not even respond to my complaint to the BBB. This bank in the last two days has charged me over $320.00 in overdraft fees, the did refund me the $125.00, why would they continously approve purchases when you didn't have enough money in your account. This bank is allowed to have this practice. I have had a pending deposit, conveniently that isn't posted as pending but the ovedraft fees are. Then I have a transfer from my checking into my savings because there wasn't any money left, they transferred the amount anyway and then charged me a fee.
My checkbook is now out $175.00, this is extortion.

After fleecing me for a processing fee and another appraisal and after pre-approving my home loan, and after setting a closing date, Wachovia turned down my loan by stating that they did not approve of my floorplan. Their first lie was that my FICO had dropped 40 points overnight. I pulled my credit report immediately and it had not changed but it took two weeks of emails from my broker for them to admit that it was a mistake. That's when they switched gears and said they didn't like my floorplan. Have you ever heard anything so ridiculous? The next day I saw on CNN that Wachovia was in financial trouble. They strung me along for over a month.
This cost me immeasurable harm, as it now shows on my FICO that they pulled my credit report twice. Additionally, I waisted valuable time waiting for my pre-approved loan. I turned down several lenders thinking that Wachovia was a better choice.

My husband and I have 4 accounts with Bank of America...1 business checking, 1 joint personal checking, 1 savings, and 1 mortgage. Our business has been struggling, and we were 3 months behind on our business credit card payment. We received one call in March from a Bank of America employee regarding the delinquent account. We told BofA that we were working on bringing the account current. We then received a letter on April 22nd stating that we had until April 29th to bring the account current. We were diligently working on that, and my husband happened to check the business account online on the morning of April 23rd to find a zero balance. I checked our joint account, and also found a zero balance.
We went to our local branch and spoke with the branch manager, who made some calls and found out that BofA had exercised their 'right of offset' and emptied both accounts without notice to apply to the business credit card. The total in both accounts was more than $2100.00. The Branch Manager, Leah Goss, really went to bat for us...we were in the bank for about 3 hours, and she agreed that it wasn't right for us to receive a letter giving us until April 29th to bring the account current, and for the bank to empty both accounts on April 23rd without even giving us a chance.
While in her office, we spoke to a representative, April Salazar, from the Bank of America Customer Assistance division, the division responsible for emptying our accounts. This person was extremely rude to us on the telephone, and said there had been numerous attempts to contact us, with no response. That is absolutely not true. We received one call, and spoke to a bank representative and explained our situation.
Yesterday, April 30th, we received a letter dated April 24, 2008 from BofA informing us that they had emptied both accounts, and that the funds would not be available as of the date of the letter, April 24th. They actually emptied the accounts on April 23rd. We certainly don't dispute the fact they we owe them money, and we have been working very hard to get our business back on track and get the bills up to date. At this point, we are short $2100 that was to have been used to help pay those bills, along with other living expenses. My issue here is the fact that Bank of America says one thing to us in writing, that we had until April 29th to resolve our problem, then they turn around and clean out our bank accounts 6 days prior to the deadline they gave us without any notice at all. Is this legal?
We are wiped out financially. No money in the bank, no money to pay our monthly bills. Our trust in the banking system has been completely shattered and we don't know where to turn.

Yesterday I had 4 transacations in my checking account's pending column. 2 debits totalling -25.00 and 2 deposits totalling +30.00. i also had a balance of +24.00 from the previous day. I incurred and overdraft fee (-35.00) in the pending transctions. There is nothing wrong with my math. BOA has designed their software to this. They counted the debits first which left me with a -1.00, which never showed in the posted transactions - because it was not an actual figure - just a technical one that lasted the duration of a nano-second: the gap between posting my debits and then posting my deposits. The computer kicked in an overdraft fee, between posting debits and deposits, and then took my 30.00 deposit and applied it to the fee leaving my account a couple dollars in the negative. (amts have been rounded off to the nearest dollar)
I had transfered the -30 into my account to get gas to go to the university, where i was planning to work on a final project. I could not make it there, and did not dare buy my kids anything for supper, for fear of incurring a string of overdrafts. They ate peanut butter sandwhiches. BOA has more of my hard earned money. I plan on cutting my losses (this has happened a few times before) and leave banking accounts altogether - the conveniece is not worth the hassle. I will just work out of a cash jar, in the house, like folks use to use.

my balance on my credit card was $22.00. i mailed my balance 7 days late. i was penalized for $15.50. that is a 75% fee for a loan of $20.00 for one week. i'm sure there are other cards around that are less onerous.

I have been a BofA customer for ten years and have never had a problem. Imagine my surprise when my check card got denied last week. I went straight to the ATM to make sure that funds were transfered from my savings to my checking. Problem solved. That night I received a notice in the mail for an insufficient fund charge.I expected that. Unfortuntely, I also received FIFTEEN more thirty five dollar fees in the next two days! They didn't bother to decline my card until I was SEVEN HUNDRED dollars in the hole.
This, of course, was just a huge snowball effect. I never knew that I was overdrawn so they just started withdrawing hundreds of dollars out of my account. I feel like I have been robbed and there is nothing I can do about it. I have spent hours pleading my case but have gotten NOWHERE. I don't mind paying the first couple of charges because they were my fault. But after that...They owed it to me to let me know there was a problem...At least decline my card so I could have straightened this out immediately. Please warn Debit card holders of this.
As for me....I'M NOT DONE FIGHTING!

Here's how my Bank statement reads today (5/02): 5/01 unavailable funds fee $70 Bal:-$105.12 5/01 Taco Bell $5.39 Bal: -35.12 5/01 McDonalds 12.33 Bal: -29.73 4/30 unavailable funds fee $35 Bal: -17.40 4/30 Cafeteria $1.40 Bal: +17.60 There are no pending purchases or check card holds. There were no further purchases made that are not displayed. The $1.40 should not have bounced. The 12.33 should not have bounced. Additionally, I made a deposit of over $100 cash at an atm on 5/01. Immediately after that, the available balance showed $65 (since the account was already negative). This morning, the 12.33 and 5.39 bounced anyway.
I am tired of the excuses. Most of the time they will refund the money, but I'm tired of having to fight with my bank over who gets to keep MY money! I am sure they have all kinds of complex policies and rules outlining every possible way they can think of to raid my bank account, but that hardly makes it right, and I question the legality of it. I was planning to use my ATM card to purchase gas this morning. It was quite a shock to see my account errantly in the negative after making a deposit the day before.

My incident has happen three times where I have used my card or wrote out checks and had to make a deposit and made that deposit, but Bank of America moved all my transactions around.
I rececently made a deposit and knew that I had two checks that would be coming in after my deposit. Bank America credited the deposit and I got on line the next day and printed down the deposit and any previous transactions and everything was find. The following day(2 days after my depost) i get online to see what have came in and Bank America has moved my deposit around to show that in came in after my debits which of course made my account overdrawn, I called them and again they told me that they did not move anything around that it was the way they came in, and when I told them that I had copies of each and every transaction dating back three days, they told me that they move thing around because this is how the customers want it.
They want all there debits from the highest amount to the lowest amount. I said that you show debits in order of high/low does not explain why you moved my depost to be credited after my debits came in and you charged me. I've had it with them, I did not want to change banks because I have been with them for some time, but they have done this more than once. In my circle of friends they say they would not deal with BofA is they tried to pay them.

I knew I was going to have to pay some things so I applied for a loan to go into my account, this was on Friday, the loan was approved and the funds to be transfered into my account on midnight Monday, I check my account Monday and nothing had cleared but I did have cash on hand so I called Wachovia and asked there rep if it was nessary to leave work to make a deposit into my account because the funds would go in that night I was told by the rep named Jennifer that said the deposits go in befor the with draws howerver they processed the charges first and put the deposit in pending so they charged me 140 in overdraft changes.

Car payment was sent back to me for improper address, received 3 weeks later. I called right away gave payment over the phone and was told to include the late fee in Februarys payment, I did that was applying for credit in June I found that they reported me to the credit bureau for Jan. Feb and March payment.
When I called they said they are allowed to take their late fee out of my payments and that I should read my contract. I did that and it stetes that the fees will be calculated at payoff time.I have never been 30 days late I even have proof from my bank statements.
Universal default with all other creditors. Companies are making my accounts 25% some even lowered their spending amounts below what is owed on the card.

I checked on my BOFA checking account and noticed that my overdraft protection had been applied to +96.00. I called to ask why and I was told that pending charges and deposits no longer apply to the balance, and I had over drafted my account. NOT according to my statement. Then I was scolded by the customer service rep about not paying attention to my balance. I've been with BOFA for ten years, and I've always used the online service and cash machines with success in determining my balance.
Apparently, there's some new rule (which I still have yet to receive a notification of) that their assessment of you balance doesn't really matter if there are pending charges. Needless to say, I did find a sympathetic ear to transfer the $100 back onto my BOFA credit card, but I have to now call the credit card company to credit me for the $10.00 overdraft protection fee. Some racket, huh. No overdraft = $100 on my credit card, + a $10.00 fee.
I live paycheck to paycheck and I used to count on BOFA to give me proper balance information. Now I have to make sure that there's a few hundred dollars cushion (according to the rep I spoke to), so I don't overdraft. $10.00 fee

i average about $430 per month in fees i have bben blaming mysel until this weekend when i caught the switch. it has wrecked my credit with past dues on mortgage and cars...very disturbung

I am currently going through a divorce, which is expensive. Since I am also a college student and mother I don't have a lot of money so my father very generously offered to transfer money into my account so that I could afford a lawyer. We both have Bank of America accounts and decided to go to the branch closest to my house to do the transfer in person. We assumed this would be easier and decrease the chance of there being any problems. When we transferred the money we were very specific about what money went into which account. The woman even repeated the info back to us to make sure it was correct. We were told the money was deposited and was available for immediate use since we had done all this in person (online takes longer to post). We then went to the lawyer's office and paid by check.
I thought everything was taken care of until a week later when my lawyer's office called me and told me that the check had bounced! BofA never emailed me or called me about this matter even though it was thousands of dollars and I am signed up for alerts when I have under $200 dollars in my account and when I overdraw. I found out at the very last minute, after I had taken off a day of work the next day to see the lawyer and talk about very critical child custody issues, that my appointment would now be cancelled, my lawyer was not reserved for me, and there wouldn't be enough time to reschedule as she had another client pay after my check had bounced.
I called BofA and asked what had happened. Apparently the woman at the bank had transferred money into a different account despite us being very clear with her and her repeating the info out loud to us. I was also charged fees, one for bouncing a check and another for overdrawing my account. I made sure that all fees would be refunded and the money would be put into the correct account, although this was over the phone so I still had to wait 2 days before it showed up on my account. The I had to wait for BofA to email or mail me a letter of apology explaining the situation so that I could show my lawyer that I was not at fault (they refused to accept payment from me since I had already bounced a check). BofA took their sweet time with the letter of apology, which caused me to completely lose any chance of getting a lawyer at the firm in time for the court date. BofA messed a lot of things up and in the end there's nothing I can do.
I lost a day of work (that I had taken off to meet with a lawyer) due to the check bouncing and my finding out less than 24 hours before the appt. My mother also lost a day of work because she was going to watch my daughter while I went to the appt so that I would save money on daycare expense since I wouldn't be gone for the whole day. I was charged 2 fees (for overdraft and a bounced check). I lost my lawyer as she had to take clients who actually paid and I never offically paid due to the check bouncing. I now will have to go to a difficult custody hearing without a lawyer all because of BofA messing up!
I probably won't lose custody of my daughter despite not having a lawyer but it has made me have to change a lot of other things such as greatly increased visitation times and much smaller amount of child support so that I have a better chance of keeping custody. If I had a lawyer I wouldn't have made those changes. My mother is also having to take another day off work so that she can come with me to court, which she wasn't planning on doing but since I don't have a lawyer I don't want to be alone in the courtroom for what I know will be a very difficult day!
Since I'm now afraid to deposit money, withdraw money, and use any money currently in the account I have been using my credit card, which I can pay easily pay off weekly when I get my paychecks since I don't have direct deposit. It does, however, make things more difficult as I normally never use my credit card except for buying textbooks and school related supplies and now I have to be very careful keeping track of what I spent, where, when, etc. and I can't track these purchases online as well as I could with a regular bank account. BofA is certainly not going to reimburse those kinds of things.
Even though they messed up big time and caused a lot of bad things to happen they don't even care! I am only keeping my account open long enough to make sure that they don't try any new stunts such as new fees. I figure I'll wait until the next statement comes out to make sure they have everything right and then close my account.

I have been a customer of bank of America for more than 10 years. I had 3 accounts with them. 1 savings and 2 checkings I decided to purchase a house (since this is a buyer's market) so i decided to sell one of my lands in for Florida for the down payment. I sold my land for $27,000. On january 7th I went to bank of America branch on Maryland parkway in Las Vegas with the buyer.. the buyer got a cashier's check from Bank of America for $27,000. I then deposited that amount in my savings account.
One month went by (check cleared) and my realtor calls to let me know we are ready to cllose escrow and need the funds. I call the bank to see my balance and to my surprise on that exact same day Feb 7 they froze the $27,000. I thought this might be a mistake or just a hold so I called the customer service and was treated like a criminal, telling me I commited fraud and that the bank was coming after me .. I demanded the reason and every single time they would hang up on me... I went to one branch and again I was treated like a criminal. A day later they froze all 3 acounts with a total of $41,000. I was left with no cash and no reason why they were doing that...
I was losing my house so i went to another brach on West warm Springs. I demanded to know why my money was frozen and MYRNA one of the teller told me that I commited fraud.. I was really upset since I was loosing my house, my money and my godfather just passed away on the 8th and i had no way of going to Europe for his burial I again told the teller to call a manager or district manager but she would not do it....She only treated to call the police and when she picked up the phone to call them, i just left Bank of America froze my account for 2 weeks, sent me a check for $14000.. where is my $27,000
With all the stress I know suffer of panic attacks and am on medication. I lost $27,000 Help I need a good lawyer

I went to Macys to purchase some items on Saturday, I tried to use my debit card and it was declined. Shocked, I call Bank of America to figure out what is going on because I know I have funds available and I am automatically transferred to the Fraud Dept. in Phoenix AZ. Because I am not fluent in English, I have my granddaughter interpret for me while I am on the phone with the fraud analyst. After taking about 30 minutes into verify my information, because they insisted that they had to find an interpreter themselves and not go through my granddaughter the fraud analyst representative Cordella said my account was blocked because there was unusual activity at the beginning of this month.
The unusual activity was an atm withdrawal of $500 at the beginning of the month, which I use to pay rent. I have been doing this for the past 2 years and now they say this is unusual activity? So my granddaughter asks the rep to explain why this is happening ALL OF A sudden, and the rep's reply was I have the authority to monitor your account, it is my job and I can put a hold on it whenever I feel like there is unusual activity. We wanted to speak with a supervisor because this person was rude, unhelpful and almost discriminating in her attitude towards us. She said I don't have a supervisor, Im a financial analyst and I was providing you exceptional service because even though you were using profanity, I dealt with it!
And we were so astonished at her accusation because we are not the type of people to use profanity in conversations. My granddaughter was out of words and just shocked at the type of service BofA was trained to provide. She was obviously not treating me as a customer, but more of an annoyance because I could not speak English well and she wanted to get us off the phone and even denied out request to speak with a supervisor. I have never felt so discriminated by a bank employee, especially a big corp like B of A. And to think that my card can be blocked, without any reason, any time they want to... it makes me cringe to my stomach.
When I was declined of a $20 charge a Macys, I was extremely embarrassed and baffled. This is my hometown dept. store where everyone knows everyone! Who is going to pay for the embarrassment I got when my card was declined? I have a chronic cardiac disease, where if I am stressed/shocked, it could be detrimental to by survival. I had to get emergency treatment with nitroglycerine at home because I was so shocked from the situation. Also, the ruthless representative at b of A made me feel unsafe with my available funds AND was illogical in her explanations as to who this is happening. From now on, every time I use my atm card, I need to be in fear that it might be declined because someone at fraud services is having a bad day.

I thought I was doing a smart thing by establishing the free access 50 account which they pushed online. I spoke with customer care to be sure I had overdraft protection, whereby they would pull money from my main checking account if ever there was not enough money there. I opened the account in February. It has been such a hassle since I signed up.
They were not pulling money from the main account and charging me 30something in fees each time. I spent 40 minutes talking and pleading with them to take those charges off because it was not my fault that they did not pull the money. According to my registry I alway had enough cash there.
I ended up with a negative balance of over $300.00. I asked them to please close the account as it was causing so much trouble. They said they couldn't because of the negative balance. (which they created mind you) Well after 2 months and over $300.00 in fees and them zapping it as soon as my direct deposit went end. I called back again to close the account.

On April 23/2008 on my bussines account deposit the exactly amount of money to cover some payments,that shows on my online statement,since is a bussines the cards are used to fill gas on 3 vehicles,1 of this transactions never shows on the system not even as pending or -$1.00. on the balance summary. Suddenly one transaction pops up posted on 04/24/08 in the account since I got the knowledge that wasn't enough money to covered inmediatly I run to the bank and deposit cash to prevent overdraft fees.mo mather that I complete the deposit succesfully and is posted on my account the Bank charge me overdraft fees on Previous transactions made the day before,
When i call them there answer was If i want to save money I need to have a pencil and paper and call my employes everydays and ask how much they spend on gas anyways I show them that the nigth before on the account I put the money to cover whatever shows online and they say that the transaction that they posted was there So i told them If was there i should put more money and not the exactly amount to cover the other ones. well is not the first time this happened to me on my bussines account but with the economical situation of the country and my personal finances I'm not longer willing to give my money just like that without acting,How many people is being treated like this.Is a bank entitled to make this kind of things,So why use the online banking to keep track and control if they don't show the transactions and they later argue that is not there mistake if the computer doesn't show it.
Is not more then $70 dollars but how many people at day is being tricked like this,also i don't think customer service have to tell you how to conduct your personal bussines

Two days ago I checked my bank account and saw Wachovia had charged me 105.00 in overdraft fees when I was ot overdrawn. Not even when they charged me the overdraft fees was I overdrawn. I called them and they immediately began to talk down to me telling me that I was overdrawn according to their tools that we the customer didnt have. I said, well according to the phone automated system and the website, I am not overdrawn. I asked have what they saw on their screen faxed to me or have them take a screen shot and e-mail it to me but of course that wouldnt happen. I got so frustrated that I hung up. I called back hoping to speak to someoen reasonable about being charged fees that I never incurred.
After five people I finally got the refund department where I was immediately talked down to and then was told I should handle my money better. I was amazed. I decided to wait to the next day to see if anything cleared according to their information and the ONLY thing that did clear was my pay check, giving me yet MORE positive balance. When I went down to the local branch I was shuffled around and told that according to their system I had items pending that caused the overdraft and that the fees were valid. I asked to speak to someone else and the woman got on the phone and explained that even she had explained the situation to me I still didnt get it and needed to talk to someone else. Liek I was stupid and just didnt understand banking practices. I spoke with Donna, and I am half tempted to put her last name here, and she told us that we had pending items that put us over. and i asked, was this a per-emptive strike for something? Because at NO POINT were we EVER overdrawn and I wanted my money back. She gave us 91 dollars back of the 105. I am not sure why.
But after that experience, I do plan to bank with credit unions ONLY from here on out. I have never had a bad experience with a credit union. I am sure they are not perfect but anything is better than banking with Wachovia. And we also have to remember, the people who work for them are drones and will defend their queen bee whatever it takes because that unemployment doesnt look very inviting. And it has to scare them that they are as vulnerable as the rest of us and the bread line will have their have name on it just like the rest of us.

I would like to file a complaint on Bank of America, MYPaydayloan, MTE Financial, and Cashusanet. Bank of America has let these companies put money in my account and take money out of my account like a revolving door. I complained to Bank of America while these transactions where pending and the give the money to them. Then they credited my account for some of the transactions and then they sent that money to these payday loan companies as well. Bank of America credited my account 740.00 nsf and then debited that money back out of my account as I used a check atm withdraw. I believe that there customer service is in on this scam.
The best I can tell is that USACASHNET exists but they refuse to give me any information on the loan. They said I would have to get it on line with a user ID and password. I have never heard of these 3 companies and I can not believe that bank of America is allowed to give my money to anyone without a signed contract , without a check, and without notify me that they are giving my money to someone and then to credit my account and send it to these same people that took it to begin with is insane. I have contacted Ken Lewis, Bank of Americas President, he put a woman in charge named Leyland Southern and she claims that the bank is not in on it but she is the one that sent my money to these companies the second .
I have been refused the information from the bank to where they are sending my money and to whom they are sending it. MTE Financial does not exists at all, it appears to be an internet scam operation that changes its name quite often and appears to be in with Bank of America quite often in this scam. MYPAYDAYLOAN is suppose to have a bank account in California but there office is suppose to be in Costa Rica. How can these companies do this. I know it has to be illegal and I want my money back. I do not believe for one minute that these companies are getting by with this without bank of Americas help. I thought my money would be safe.
Is it not the law that Bank of America has to have my signature for the realize of my money to a company. I am furious. Leilani Southern refused to answer my emails and has blocked me from emailing her. Avoiding this situation will not cause it to go away. It is oblivious to me that she must be in on this as well. Anything you can do I would appreciate, I have filed complaints with the Better Business Bureau, against Cashusanet and Bank of America, how ever I can not find the addresses of the other 2 companies to file against them. MTE Financial and MYPAYDAYLOAN I believe are just bank of accounts connected with Bank of America Employees. I have also written governor Blunt and Senator McMcaskill and filed a complaint with the FDIC on Bank of America. Any information you can provide me with on these four companies would be greatly appreciated.
I am out about 1300.00, 740.00 bank fees which I was credited and then it was taken back out by Leilani Southern as atm withdraws. And the money that was credited into my account has also been given to these companies by Leilani Southern.

Everyone be aware of BOA's new policy, that by the way I was never notified about, until I got over 200.00 dollars in over draft fees. BOA says you now have to have the funds available when you swipe your card, meaning lets say you have 10.00 in your account make a purchase for 11.00, you realize you went over and deposit or even transfer that amount from savings to checking, well that does not matter (even if the transaction is pending)you swiped the card the funds where not available so you get a 35.00 overdraft fee. Now here is the kicker a BOA says there was a survey done and majority said that they do not want things to post until midnight the following business day. Be careful how you spend your money on the weekends when items hit monday morning you have better taken in to consideration any overdraft fees you might get. With the new policy this is what happen to me.
I had 200.00 in my checking account,I spent 80.00 at one store then 122.00 at another store. Realizing I went over went directly online and transfered 70.00 from my savings to checking (before any cut off time), and was showing my available balance was now 68.00. Well now that I have an available balance I go eat and buy a couple other things not going over my now available balance of 68.00. Well come monday morning I am negative! Why well when I swiped my card the funds where not available so I received two overdraft fees for 35.00 dollars. now I still have the other purchases pending (when I swiped my card the funds where available)Since I was not charged the overdraft fees until monday these other pending purchases will now receive overdraft fees even though when I swiped my card they where available, and I'm told even if I transfer money over I will still get overdraft fees for the pending transaction because the computer system will not recognize the funds being there for these other purchases.
I thought the purchase was fine as long as the amount was available when you swipe your card? not after any fees you may or may not get. Its seems to me that polocies always change to benefit the company and never the consumer, but we are told it is for our protection or benefit(aload of you know what!).
After all was said and done I got 8 overdraft fees total. I was told that the system decisioned my fees and there was no way to refund the fees. Another load of you know what, do not ever let a bank tell you there is no way to get your money back there is always a way to override, or get your money back always! After a week of calling and going over my account with supervisor after suprvisor I did get back my fees but if I had not been persistant and almost threatning this would never had happened. Never let them take advantage of you with new polocies and procedures that never make any sense except to the bank or computer taking your money.

These wonderful folks dinged me for $70.00 in NSF charges. I have went over my latest statement line by line and did not see once where my checking account had a negative balance. There was a balance of $7.33 and no there was not a negative sign in fromnt of that balance. Somehow these cons assessed me $70.00 which represents TWO NSF Fees and supposedly another is on the way. Is this their new creative way of making up for their loan losses?
Also, I called to cancel my WAY TO SAVE account. I was told there would be a $25.00 cancellation fee. This was never explained to me on the phone when I opened the account. It seems this bank from hell has found creative ways to try and confuse the customer and screw them with excessive fees. I have seen SEVERAL complaints regarding this same issue with Wachovia.
The customer service is good when things are going well but when the chips fall th3e customer service is terrible. It seems they aren't properly trained to handle difficult calls. One respresentative even hung up on me. I didn't use any foul language or raise my voice. This bank is a joke! I don't expect any resolution by any means, but if I can save one person from this bank's practices, I have done my job! CONSUMER BEWARE!

We have banked with Wachovia now for over 5 years. The reason we started banking with them was because my husband's paychecks automatically dealt with Wachovia by doing their direct deposit... so.. to keep things simple (or so we thought), we just let his checks go into Wachovia, and opened an account with them.
Fast forward to almost 5 years later and we are fed up with their terrible customer service, and 'loose' policy on overdraft fees. Everytime we have had an issue with Wachovia, we are transferred from representative to representative, and subsequently dealt with in a rude manner.
My main complaint with them has to do with their overdraft fees. The first time, my husband had a paycheck go into Wachovia at midnight on Thursday night. On Friday, when we checked the account, two bills had posted to our account - which was fine, because his paycheck had posted the day before (as it had many times before). Well, on Monday, when I checked our account again, Wachovia had decided to process the two bills, and THEN process my husbands direct deposit paycheck - thereby, charging us an obscene amount in overdraft fees. This happened a few more times - where they would debit our account AFTER a paycheck or deposit had posted and then process them backwards - thereby enabling them to charge us overdraft fees before they posted.
This last time, we accidentally had our mortgage taken out of our account twice. I called them immediately about this, and got the second payment wired back into the account - which, of course would take 24-48 hours. I also told them that I had bills sent out to be debited from our account the same day our money mistakenly taken out would be wired back in. They said it would not be a problem and assured me the mortgage money would be counted in and then the bills debited out.
Well, it turns out, that they have posted our mortgage credit, then our bills going out... yet still charged us almost $400 in overdraft fees!! Even though the bills AND mortgage refund are both still processing - they are processing our bills first so they can charge us for the initial mistake of double drawing our mortgage!! I'm fed up with this bank - they are only out to make money for their shareholders, while putting customers like me in a very tight spot financially. If I could post this complaint all over the U.S., I would so that no other family would entrust their money to this debacle of an institution! We are pulling our accounts and sending everything to Navy Federal! Wachovia STINKS!

I recently rented out a house while at college and was told that I had nearly perfect credit, at least up until now. I received a debt collections notice yesterday from NCO in reference to a Wachovia Student Checking account that I had closed in December 2006 along with my Savings account. The charge was for an inactive account fee of 5 dollars on account that has been zeroed out for the last year, thus putting me in the negative and accumulating 50 dollars in charges.
Problem is, is that I closed those accounts, stopped receiving statements, and haven't even been able to log into my Wachovia online banking account. If this checking account was still active, has my account information been going to some other house? And why was NCO able to contact me while Wachovia has failed to snail mail or call me? I have called both NCO and Wachovia and both say there is absolutely nothing they can do about it. Wachovia in particular has called me a liar straight to my face and refused to send me up the chain so I could talk to a manager. I was polite the entire time, my roommate kept asking for the phone since I refused to yell, yet I was treated like scum. My question is, is why would my savings account close when both my savings and checking were to be closed at the same time?
This will probably end up costing me the full amount of $54.10 listed + interest to NCO as I try and present my case. However, so far no one from Wachovia has treated me with respect and as a college student, I don't exactly have an extra 60 bucks laying around.

I recieve SSI (direct deposit) and they are giving me different reasons why my money is gone. Im too broke to hire an ATTY. and they are trying to convince me that the treasury department sent me a bounced check back in january ...HMMMMM! PLEASE HELP ME!

I banked with Wachovia ever since I turned 18 (12 years). I always got NSF fees! The last straw was when a family member, who has since then paid me back, stole my checking acct. # She set up automatic debits from my acct. to pay her bill! Anyways, when I finally caught on to it Wachovia had fee'ed me to death. No loyal customer protection, no help, too darn bad for you.
They did the same thing to me like everyone else. Put the big ones through, let the little ones add up. Hold payments, hold deposits,screw all they can. I am still so angry so bear with me. When I asked them to put a freeze on my acct. or do something, anything to help me , I'm sorry ,until you bring your account out of the negative there's not much we can do.
Meanwhile I'm making deposits upon deposits, getting different balances- still negative!!! WTH! At least they could have stopped that company from debiting again, but that would have taken some work you know effort. I don't know if I can put a monetary value on what they have taken from me. But I believe it to be close to $3,000 over the last 10 years. Not only that but my exp. with them has cost me emotional problems as far as money goes. Did you know I had to go get pills, pills!, so I could sleep at night. And my children went w/o food several times. I knew they were hungry, but there was no more. Thank you Wachovia, I am a nervous spender,late bill payer, and happy Bank Of America customer.

Wachovia is a screw their customer bank! If you have a charge on hold that counts against your available balance. If you make a large purchase, and a large deposit, the purchase goes on hold immediately - authorizing a future payment, the deposit takes time to clear. Here's where it gets fuzzy - and their customer service rep doesn't understand why either (except to screw their customer). The previous on hold items are presented for payment resulting in an overdraft. This is caused by the on hold large payment which still has not been presented for payment. These items are charged an overdraft charge, as is the on hold item which caused all of this rucus (still not yet actually presented for payment) all the while waiting for the deposit to clear.
My question is how can they justify charging overdrafts for funds they have not actually released? Why did they ignore the deposit in process - it was a cash after hours ATM deposit. They gave themselves the benifit of the doubt so they could charge an exorbidant number of overdraft fees!

I have a business account with Wachovia. Over the last month, I have made 3 large money wires. The first wire was blotched by an employee who misspelled the recipients name (even though I spelled it right, and the branch initiating the wire spelled it right on their forms that went to corporate) and took over a month to get to the recipient - and about 10 hours of my time (3 trips to the bank, many phone calls to the recipients bank) to resolve. Moreover, this recipient thinks I am incompetent and has since put terms in place that requires I prepay 2 weeks before any future purchases.
The second wire I sent went through to the recipient fine - it was only a matter of 2 days.
The third wire is a nightmare, and still unresolved. I sent a very large wire, and SOMEHOW it was duplicated - sent twice. This overdrafted my account, causing about $300 in fees. Fortunately I had enough money in my personal account to transfer in to keep running my business until they resolved it. Now they are evidently not able to recall the duplicate wire. They will likely refund the overdraft fee - however it is the fact that I have to watch over Wachovia like a 2 year old, and the amount of time I have had to spend resolving things that should never occur. I am literally scared to keep using their bank.
None of these nightmares originated at my branch - these are all problems that occurred in one of their corporate offices. I do not suggest using Wachovia for money wires.

On Wednesday, April 9, I attempted to cash my paycheck. I was told by the teller that my money would not be available for two days, so I went to Bank of America (where the check was drawn) to cash the check. Bank of America charged me $5.00 for this service. I then returned to Wachovia to deposit the cash. The teller at Wachovia then informed me that, because it was after 2:00 pm, my money would not be available until after midnight on the following day, 4/11. They also told me that my money would be available at midnight that night if I deposited the cash through the ATM. I have reservations about making a cash deposit via ATM and I told the manager this. He assured me that there would be no problem.
Sure enough, my money is being held for FIVE days, my $920.00 CASH deposit. In the meantime, my car payment will undoubtedly go through, netting the bank $35.00 for an NSF fee. Needless to say, I am livid. I thought other banks were bad, but Wachovia..by far..is the worst bank that I have ever dealt with. I can't even talk to anyone until tomorrow morning, because I have to speak to a specific person in Loss Prevention. The banks are doing the same thing they did in the depression,stealing people's hard-earned money. The only difference is that now they are doing it through the guise of legality.
This will probably result, as previously stated, in my car payment being returned and an NSF fee charged to my account.

My balance was low in my checking account so I transferred money from my savings to my checking to over my debts. The next money I saw my account OD. They transfer I did the night before (I did online at 10pm) did not post. When I called customer service about it, they would not help me. They only told me my account was on hold until 2pm and I would not be able to use my account until then. EVEN THOUGHT I HAVE MONEY IN MY ACCOUNT AND TRANSFERRED THE MONEY FROM THE DAY BEFORE. I also got charged $35 per item that cleared.

A few years back I had opened an account with B of A. I also took out an auto loan with them. After a nasty divorce I went into ruin and my vehicle was repod and my accounts closed. I had UNKNOWINGLY overdrawn my account by $ .84 cents. They then out my information into a system that resulted in me not being able to open a bank account anywhere. I had no choice but to return to bank of america to open another account. At that time i was in the process of paying off all of my debts and had already payed off a $4,000 dollar credit card bill through them. The last thing i had was the remainder of the repo, after contacting them to set up some kind of payment plan, they were VERY eager not to help and it almost seemed like they were enjoying being diffuclt.
After some harsh words from their end i decided to try another day and work with another rep. They had other plans.... I had multiple savings accounts with them. I had one set up for the lawyer bills i have in my custody case that is still going on. To make a long story short, they zeroed out that account to put toward the repo account. I am now left with almost nothing and lawyer fees that i am unable to pay. I pray that I do not lose custody of my son over this.

I recently saw a $25 dollar charge on my regular checking account that I have had for 3 years. I never had this charge before. It stated Advantage Monthly Maintenance Fee. I looked it up and it is associated with the Advantage Checking account, which I do not have nor did I sign up for. I called BOA and inquired about it, they said I must carry a balance of $25,000 to avoid the fee. What? I don't have that kind of money!!
Apparently they decided to enroll me in the Advantage account without my permission. I was told I was enrolled because I carry high balances and I have a mortgage I have never owned a home! When I tried to cancel the rep told me that I could no longer receive free checks. Oh, like free checks is worth the $25 per month you are going to charge me? Thats $300 a year! Glad they were able to refund and disenroll me. Still, this is illegal!

I've had my payroll check from Verizon Business deposited into my checking account with BOA for 3+ years now. I made an adjustment in my auto deposit, which resulted in me getting a live check, rather than having it deposited. When I took the check to the bank, they held the check for a week, causing several of my auto ACH's to be charged a 35.00 NSF for each. When I contacted them about this, they suggested I get overdraft protection.
They were holding my paycheck hostage, and charging me 35.00 a pop for the pleasure of doing so!
My complaint is the lack of customer service, for a loyal customer, of over 10 years. Their pre-packaged auto responses are insulting and their lack of individual consideration based on a case by case basis, is ridiculous!

Bank of america charged me the amount of $35.00 eight different times in a two week period for being overdrawn. They did not care that it was the same company(l.a fitness) over and over trying trying to do a direct withdrawl.I called a few supervisors and they almost sounded excited to not help me out.

I wrote a B/A check to pay a pool installer. the work was really bad and the job was not completed. I telephoned Bank of America to stop payment of the check and was advised on several days the check had been stopped and I did not have to worry. Well guess what the check was paid.
I had to pay the $2000.00 plus interest to save my credit. I did close the account.

I have unauthorized withdrawals from my checking account of $25.90 from AOL and Bank of America refuses to get involved because I did not report it within 60 days. These charges caused my account to become overdrawn and they are charging me $200 in overdraft fees. In addition, I asked they close my account and that I would make monthly payments to them to clear up the debt and they responded we cannot close the account until the debt is paid. This means they will continue to pay AOL (who is not authorized to withdraw funds from my account) and charge me the overdraft fee. Furthermore, they will continue to charge me the $5.00 service fee each month. I explained to them I have not worked in over a year and the best I can do is make a small monthly payment to satisfy the charges and they will not accept that. So my account remains open and charges keep building because they refuse to close it. What type of business are they running?
Their refusal to close my account is costing me overdraft charges on unauthorized transactions and they continue to charge me $5 a month for a service fee when I have not used the account in over 3 months.

I am a patron of Wachovia Bank and I found on April 1,2008 a $20.00 dollar bill in their lobby. Now I did the right and just deed of turning in the $20.00 dollars to the bank and in doing so left with teller Claudia Bello my personal home and private phone number in case Wachovia wants to thank me for my honesty or something. Claudia Bello verbally attacked me and I am a person who has a disability and had a doctor's appointment today as a result of Claudia Bello's stress placed on me. I was nervous and the doctor saw it.
The physical damage is I am already disabled and sickly and the Wachivia manager did not apologize nor come out to stop Claudia Bello from attacking me verbally before other Wachovia guests and her fellow workers including a worker by the name of Rafeena Bisram who added her to cents to a matter that did not concern her while other employees laughed at me. How rude and unprofessional of Wachovia. This bank location always had problems.They are not professional and very uncaring towards us patrons who keep them employed with jobs.

Let me start by saying I have excellent credit. Three weeks ago I was paying a credit card online. I inadvertently checked the box to pay the entire balance of $2400.00. In addition, I had already made an earlier payment of $600.00 so no additional payment was necessary until next month. 5 days later I checked my Wachovia account and found out I had a negative balance of 1200.00. Once I determined what had happened, I called the credit card company. They fixed the problem and credited the $2400.00 back to my Wachovia account.
By the time it was credited, Wachovia had charged me $300 in overdraft fees (all from small purchases such as gas and restaurant charges). I called Wachovia and they told me that since I was a good customer and had been with them for quite a while (10+ years) they paid the requested credit card amount of $2400.00. If they had not made the payment to the credit card company which resulted in a negative balance of $1200.00, I would have had 1 overdraft fee of $35.00. Instead since I was a good customer, I wound up paying over $300. Two questions: 1) Can Wachovia decide to pay any amount it wants even if it results in a high negative balance? I don't think I ever agreed to this when I opened the account. Wachovia told me that they have a maximum amount that they will cover but they cannot tell me what that amount is. 2) Doesn't this seem absurd?

B of A held deposited funds for six weeks, well after the sending bank cleared the check, before allowing funds to be available in a small business checking account. Thereby, B of A could claim overdraft fees on funds they extended to pay claimed overdrafts; such credit extended without my written permission.
When notified no permission was granted, the bank should have closed the account but instead continued the overdrafting. All this occurred while there were sufficient funds in a linked savings account to prevent overdrafts.
The bank claimed no access to said funds when this was pointed out, claimed they had no signature from me. Then they started withdrawing funds to pay the bounced checks.
Six weeks later, the last deposit made and cleared from the sending bank has not been made available to my account.
I do not believe this to be harmless error.

I unfortunately was involved in an internet scam that was quite elaborate. I received a check that was deposited in a newly opened account separate from my regular account. A couple days after the check was deposited, the full amount of the check was available to be withdrawn, which to most people means a check has cleared.
I didn't have my new card so I had to transfer funds to another account. Bank of America decided the check was phony, pulled it and canceled the account. Then they recouped the money they released from my account I transferred to. I lost $2200 on the counterfeit check.
They basically said I should read their fine print and that they can do nothing for me.

Last week, I went to Bank of America to ask for a reversal of a $12 fee. After I was refused, I withdrew $370,000 from the account. Later, it dawned on me that the Branch Manager (Yuba City,CA) allowed me to make the withdraw without showing a single piece of ID! She didn't even ask for my social security number. All I showed her was a PHOTOCOPY of a single page of a recent bank statement. Any number of people could have had easy access to that (from my home office or garbage can).
I still hold a large account at Bank of America and am looking for reassurance that my funds are safe. If I had been anyone else other than myself last week, only part ($200,000) of those funds would have been insured. That Bank Manager put $170,000 of my funds at risk! I tried going online and calling several phone numbers to try and find out where to write a Letter of Concern to Bank of America and got nowhere. What to do?

I was charged three overdraft fees for the amount of $35 each time for overdrawing my account. I made the deposit before and was charged the amounts, so my account was showing as positive. I did a transfer of one dollar to another account. Now the bank said they will charge me again 35 dollars for overdraft fee because the transfer was cleared later than the time I did the transfer. And after charging me with three overdraft fees my account was negative, and was what caused the one dollar charge to make another transaction over the limit. What looks like to be caused by the bank. A month ago I was charged an annual fee of 29 dollar that cause my account to be over the limit. The bank charged me again a 39 dollars over limit fee that was caused by them.
I have no money to eat. My budget is small and all these charges will make my life harder. It may seem small money for others, but I believe I should earn my money honestly to live. I believe such a behavior from the part of a financial institution is not fair. The charge could be avoided. First if I could have the option not to allow transactions to go through If I had no funds in my account. Second, If the over limit fee would be charged right after I was overdrawn. Now I have no money to pay for gas and no money for food because I am charged three times, not one time the overdraft fee. This would be much more fair if reduced to one fee.

I had been a customer of Wachovia for about 6 months, but when I opened the account, they told me that my wife could not be on the account because her credit score was not good enough. So I opened a business account and a personal account with them. One Friday I deposited cash into the business account, and was told it would post the same day since it was cash. (The reason I did cash is because I own a landscape business, and I once deposited a check from a customer that bounced. Wachovia charged ME $40 for the bounced check that was only $35 to begin with. So I had been to the bank the check was written on and cashed it before I went to deposit the money in my account.) I later went to the store and used my debit card for the purchase, even though I had cash in my pocket, because I was told it was posted the same day. I continued to use the debit card over the weekend. The following Monday, I checked my balance and it was negative. After calling the back, I was told there were 7 NSF charges of $35 each for the debit transactions I had made over the weekend.
After spending 3 hours at the bank talking to different managers I was told that the money was actually just soft posted, and it really wasn't available until the next business day. If I had known that, I would have kept the cash to spend for the weekend and not gone to the bank with it. I was furious that they had taken my hard- earned money. Since that account was already negative, I took all but $12 out of my personal account (because they said there might be outstanding charges on that one, and I could not close it). I have since been sent letters from Wachovia and now attorneys offices saying I owe them $1000 for the business account, and $260 for the personal account because they have charged me monthly fees for the accounts being negative each month.
And after all of this, I find out the real reason for my wife not being on the account is because she had an account with SouthTrust Bank 12 years ago. She stopped using the account, but never closed it. It was left with a small balance, and she thought it was all right because it was a free account (no service fees.) She stopped receiving statements and was told by the bank that the account was closed due to inactivity. About 7 years later, after Wachovia had bought out SouthTrust, she received a letter stating that she owed Wachovia $1200 for her account. They had taken the account (which had never really been closed) and changed it to an account that had a monthly service charge of $35. Every time they took the $35 out of the account, they would also charge another $35 for overdraft fees. After a year of these charges, they say they closed the account. We do not feel we owe Wachovia this money, and I will tell everyone I know not to bank with this company.

After waiting for a period of time, Tej Randhawa of Bank Of America in Sunnyvale has wasted my time to deposit a client's check that they stated will only take a few minutes. After waiting, Tej has decided to tell me I can cash my check elsewhere as I told him I will wait patiently as I stood in line for a period of time to get my check cashed. I need to move forward with the project; my client has signed a budget for products which now has been delayed. After speaking with my client, they were upset and I had explained to him that I cannot accept any more checks from Bank of America as they were charging $5 per check which delays every project that is assigned by my client.
As stated by the client, they are very upset and had to be apologetic for Bank of America's actions, represented by Tej Randhawa of Bank of America. During the waiting period, the check was not verified in any way as Tej just sat there looking at me and not taking action. Definitely would overview his skills as a bank associate.
This has damaged the clients reputation due to their BofA banking affiliation. The job cannot be complete since payment was not collected or verified to cash a budgeted project.

If you want to dispute a charge to any of your accounts that a company has made without your authorization, BofA will allow you to file a dispute. However, when I call to dispute a charge BofA made to my personal checking account, I was told there was no way to dispute the charge, let alone file a complaint. This is illegal.

I advised Wachovia of my husband's death, he is ALSO named on the register/title, along with myself. Over the past 5months, I have made several phone calls and contacted Wachovia's representatives in attempt to resolve this matter so that my vehicle can be re-registered and my name be listed solely now that my husband is deceased. Wachovia representatives assured me on several occasions that this information would be forwarded directly to me and the DMV to have my vehicle registered and info placed into my name. Each occasion I spoke with a representative, I was told I had to wait two weeks, or that this information had been submitted accordingly so that I can have my vehicle reinstated.
It is now March and this has NOT been done. I am unable to drive my car because the car is not registered, yet I have maintained the required insurance for the vehicle. I am now getting parking tickets because of the invalid and outdated plates! Since my vehicle is parked on the street, the car is starting to deteriorate and has gotten a flat tire (on newly obtained tires I might add) just recently from lack of use. I am having to resort to public transportation and a major lifestyle change. I have been inconvenienced and stressed and frustrated due to their ineptitude and lack of professionalism as a result of their lying and improper handling of this situation. I am already named on the title/registration. THIS MATTER needs to be resolved ASAP. There is no reason why I have to endure the drama.

I had a balance of $140. I had 2 outstanding transactions one of $112 and one for $30. The $112 was a surprise to me as the institution that took that transaction did not tell me about the $2 fee. So I had thought I had exactly $140 outstanding. In any case, these items have not yet posted or debited from my account. However, Wachovia has since assessed my account with a $35 unavailable funds fee. So I called to ask them about it. How is it I'm being charged for a $35 fee for an item that hasn't been posted? The response was, it has posted. Then why is my balance still positive? Well your actual balance is still positive but your available balance is not. They call it a soft post fee. I said, So you charge me a soft post fee and a hard post fee? Keep in mind this is the TELLER MANAGER that I spoke with, he responded with, Sounds like you could really benefit from writing down your transactions. I work in the financial services industry. I am not an idiot. I know how to balance my checkbook. But God forbid LIFE happens to you, because Wachovia will not have your back. I hope this turns into a class action.
So far $35 in fees, but I'm certain that between now and the time that I leave to deposit the money they will find away to charge me about $70 more in fees.

I have been a customer of Wachovia for 8 years. Unfortunately, Wachovia bought out First Union, and since then, I have been charged so many fees. I have many instances where I may go over 2 pennies on my checking account, and Wachovia will then charge me a $35.00 NSF for 2 pennies. I think they sit and wait for a customer to fall a few cents in the negative so they can quickly charge that $35.00 fee. They have fee(d) me to death, and I hope some other bank comes along and buys them out, and replaces them with caring individuals who are not just out to fee their customers to death. Being a customer with a bank for 8 years should count for something. I am now banking with another area bank who treats me so much better.
As a result of being charged so many fees over the years, I have lost hundreds and hundreds of dollars.

My complaint is on on Bank of Smerica, p.o. Box 25118, Tampa, Florida 33622. The issue is their check depositing practice. I have been a customer since 1999. Because I have had issues with Bank of America before, I stopped depositing my work check electronically to them. Last week I deposited a check from my credit union account, and on Monday I checked the status, and it was placed on hold; but when I called my credit union, which is in California, the check was cleared! I called because the money was to move into an apartment, and I was supposed to give the money to my new landlord and had a deadline to leave my present apartment.
I spoke to a rep and supervisor, and neither seem to have a solution for me but to wait until Friday! I offered to have the credit union to fax proof it was with drawn, and the rep couldn't even figure out who to direct the credit union rep to, to send the fax to show it was taken out. The credit union couldn't understand the hold nor the rep and supervisor's lack of knowledge on how to help me. I would like Bank of America to tell me why would they put a hold on my check? I've never had a returned check with the company!
I have to move my things to storage for 2 days! And my 4-year-old and I have to go to a hotel.

This incident was happening around 1997. I would always deposit my husband's paycheck every Friday (a FedEx company check) into the Westchester Branch's ATM Machine, even though our Branch was in Culver City. Every month they seemed to lose 1 of his paychecks and not post it until about 1 month later. Oh, I would call the bank as soon as I made the deposit to check and see if they got it. They would say it's in a misc. bank account because we did not know what account# to post it to.
I told them the acct.# is on the back of the check--how can you not know? Then they started charging us NSF's, overdrafts, etc., and never credited our acct. Finally I left for WELLS FARGO BANK.

I put in a PayPal transfer to my checking account on March 4, 2008. PayPal put the status as Completed at 20:29:01 PST. I wrote a check to my child's school with PayPal showing that the trasfer was completed. Bank of America (BoA) didn't put a hit back to PayPal until March 7, 2008 so the check that I had written to my child's school put my account into overdraft. As of 1:35AM on March 7, 2008, the check withdrawl was still pending so I thought I was alright and that the transfer would go through BEFORE the check was deducted from my account.

I was charged a fees of $221.52 for a second time. After I had already paid this amount over the phone with a credit card. Company has poor communication within itself. I wasted a whole day trying to get the branch manager Alex to understand my case, unsuccessfully. I went back a second day spoke with Karla R. she was able to understand my issue and was willing to help resolve it, she herself also experienced a hard time over the phone with her company and branch manager explaining my case. I would not have gone into the negative had I not been double charged by the bank. Which was a bank error. Second issue I have had with this bank.
I wasted two days of going back and forth over the phone and in person to get this issue resolved. Bank charged me overdraft fees for a bank error. They also are holding on to $221.52 of my money

My mortgage company switched a few months ago from World Savings to Wachovia. I recently got a letter from Wachovia stating that I had not replied to 2 other letters they sent me requesting proof of insurance, so they have taken out insurance for me (at a very high rate) and have set up an escrow account. I immediately faxed them proof of insurance, only to find out after calling that they needed my condo policy (letter was not specific). I live outside of the country and am renting out my condo. This has been a major pain to me. My condo association manager faxed them the policy, but because they did not put my policy number on it (although all my other info was there), Wachovia trashed it. I find this type of action to be unbelievable that they can just take out insurance and ask me for payment. It seems like it was an attempted scam, and their customer service people are awful. I've had to spend my own money calling internationally, waiting a long time on hold for a rep. It seems like some kind of class action law suit against Wachovia could be pursued. Has anyone else experienced this?
Loss of funds due to escrow account being set up without my permission. International phone calls lasting half hour waiting on hold and then discussing with rep have been costly (I live outside USA, and rent out my USA condo).

My husband and I transferred $1000 from our Bank of America in Sunland, California. The date was Nov 15, 2007. We transferred it to our account in Costa Rica, at Coopemex, San Jose, Costa Rica. Our account was billed for the $1000 and also a wire transfer fee of $45 approximately. The money was taken from our account, and it never arrived to our Costa Rica account. We discovered this when we went to Costa Rica for a vacation, and the money was not there. Additionally, when we tried to phone B of A from Costa Rica, even though we phoned toll free numbers, we were billed for the calls totaling about $50. We have attempted for weeks and weeks to resolve this, and we are getting no help from B of A. Our money was stolen.
We are being denied the funds and any interest it might have accrued. Plus we are being billed for the phone calls to try to resolve it. This is theft.

I have been a loan officer for 5 years and 4 of those five years I was employed by Wachovia Bank and Wilmington Finance. Both companies were originated back east so their philosophy and business tactics are harsh and money motivated. All they care about is the bottom line... period! So keep this in mind when I am explaining what I have observed in the last 4 years.
I will start first with Wilmington Finance. I managed a satelite branch for them for 4 years. Although I was conpensated very well it came with a price tag. We were trained and taught to never disclose interest rate, fees, costs, etc with the customer. Our regional manager would hold conferences calls every week with myself and other managers to make sure we were charging as much as possible on all our loans including putting 5 year 5% Pre-Payment Penalties on every loan, even if they were 2, or 3 year ARM's. If the branch wasn't opperating or what I like to say screwing people enough we would have mandatory Saturday work days and 9am to 7pm work hours throughout the week to make up for lost profit.
At Wachovia, charging the customer and non-disclosing important facts about the loan is also the philosophy of the corporation. I met with a top line manager named Matt, who was a big time banker in New Jersey who personally explained his recipe of success to me. When he would write a first mortgage for someone he would thank them by putting a line of credit (HELOC) behind the first mortgage without even telling his customer about it. What a guy huh???
The line of credit carried a 15% interest rate, had a 3 year early closure fee, and was another lein against the property. This is all too common and my list of stories could go on but I don't think there is enough time in the day.
People wonder why we are in such a mess with the housing market and there is your answer. I would strongly urge anyone to stay away from these two companies. Obviously there are more out there and maybe I will write about those too soon.
Defaulted mortgages caused these two companies to layoff 1/3 of their mortgage division staff.

I deposited my husband's check into my account at a local ATM. It is a small town, everyone knows everyone; the bank mailed it back to me stating he was not on my account, which caused 4 items to bounce, charging me $140.00. I called their customer service line. The rep there told me that the check was on hold until midnight, and that the funds would be released. But this didn't happen.
Bank of America refused to credit me the overdraft fees, even after they admitted they were wrong.

I opened a Prima Account through a branch and specifically told the staff that I have mortgage with BA, so any fees associated with Prima account would be waived. This is my 2nd Prima account, so I knew how the process would be. Unbeknown to me how incompetent the staff would be, she opened my account without notating the waived charges. Therefore, from 9/2007 to 3/2008, my account has been charged $20 monthly service charges. I called in March 2008 as soon as I saw these charges on my statement. I went to the branch and called the 800 #; the only thing they were able to do was to credit me for 3 months. I would have to be responsible for the other lost fees because I wasn't checking my statement. I am still very fired up regarding this issue, as it was a staff problem by BA; and they should be liable for this and give me back my money!
I suffer monetary damages by these service charges, lost time and effort in attempts to try to resolve issue, but efforts were worthless.

My ex-Husband and I had refinanced an equity loan on our then home. I had no income and bad credit. The original loan was in his name. We both signed the mortgage papers at the bank because my name was on the deed. Nothing was to be different except the equity line was being increased. A few months later as I was looking over the documents again, I realized that the loan was put into my name not my husband's. I called the bank and asked why was this done. They had no answer. I told them I had no income, and why would it now be in my name with bad credit and no job and not in my husbands who had good credit and a career? No one could do anything and told me that is how it is, and we would have to refile to fix it and pay the money to redo the loan. We were divorced in Dec. of 2005. I signed the house over to my ex in exchange for him to take over mortgage and payments. I have a court order signed by a judge where ex agreed to do so and not hold me liable.
April of 2007 house was foreclosed and sold at sheriff's auction. Ex-husband failed to follow court order and remove the mortgage from my name and put into his. A $212,000 foreclosure is now on my credit report and is causing me great damage to credit. Bank of America/Fleet would NOT do anything to correct the error. They gave a mortgage to someone who has bad credit, as I did, and no income what-so-ever. What were they thinking? I now have my credit ruined when my ex had his name on the original documents, and Bank of America/Fleet messed it up and put mine instead!

For the second time in two years, I got a fraudulent charge on my debit card for $9.10 from a companny called Terra in FL. The telephone number (877-340-2372) listed is bogus. Wachovia refused to do anything about it, telling me that I was a cheakskate for not just paying such a small amount and forgetting it. I was told would make me sorry if I chose to pursue it. I chose to pursue it and Wachovia took punitive action against me.
From press reports I have learned that there are literally tens of thousands of complaints about Wachovia doing this and reaping millions in income from returned item fees charged to the scammers. (Of course these fees are being collected from payments from people who did not notice or protest these fraudulent charges on their statements.)
My debit cards were cancelled and no replacements provided. My accounts were blocked, including accounts not related to this at all such as time deposits belonging to my wife. The $9.10 was credited back to my account, but was reported to Experian as a chargeoff. This will take months to get off my credit report even though it is entirely false. My wife tried to intervene and was told she was stupid for even calling. (She is a PhD and a prominent researcher and anything but stipid.)
At this point we cannot even access our funds to withdraw them. Online bill pay payments are bouncing because the accounts are blocked.
No one at customer service or at branches have been helpful or sympathetic in any way. Two people have confided that Wachovia is making millions off these scams and they are getting hundreds of complaints a day about the scams.
Why can't these people be stopped? It is because they are in tight with the Bush administration?
I was a banker for over 30 years and no bank I ever worked for did things like this.

I have had several complaints against Wachovia over the years. No one has ever responded. I actually went into a branch this last time and still no help. Customer Service doesn't exist anymore. I have had SEVERAL hits on my account over the years for the same reason everyone else complains about: ODF's. We could write 10 checks and 9 would clear, but because of one check being more than the whole balance, Wachovia would bounce all 10 items charge us a fee of $350.00. Send everything back, and then we would get charges from other places, and Wachvoia would say. TOO BAD. We want all of our overdrafts back from the date that we opened our account, and we will close it.

I've been having trouble with the mortgage I have with World Savings being credited when I made a payment by mail. Neither payment I made in July nor a payment I made in October of 2007 were credited to my account. I had purchased a money order each time and mailed them in. The ones I personally took to the physical locations were received and posted to my mortgage account. I finally got the information from the Post Office that neither of the money orders were processed through the bank. This caused the payments to be unpaid and subject to $39 fees for being late.
I paid extra payments during several months both between the missed payments and after the last missed payment. I received foreclosure threatening letters. I got phone calls at all times during the day and even on Super Bowl sunday in the middle of the game. I kept trying to get an explanation about why I kept having this problem and each man I spoke to at the bank was difficult to deal with. They were haughty and refused to assist me until I had brought the situation to a current status. They were arrogant and refused to even research the problem from their end so I could understand what had occurred. A woman, Jeanne, finally assisted me by looking over the history of my loan and found that a payment in July was not credited, nor was the October payment shown. I have the money order receipts from each of the money orders I had purchased, so I know the dates I purchased them on. I also know that on those two months I needed to mail the payments in, not visit the branch. I contacted the Post Office and learned that the money orders in question, the ones I mailed, had never been processed. I will get a reimbursement from the Post Office, however the damage has been done. I went physically into the branch today and learned that World Savings had retained its mortgage division. This was news to me and I had never been informed that I could still visit the branch of World Savings, now Wachovia, that I had used in the past to pay my mortgage.
I have been charged approximately $195 in late fees. My credit took a nose dive each time I was late and now is around 500 even. This has caused me to have difficulty in trying to refinance away from this bank. I cannot get a decent rate, the best I can do is 5.99% with buying 2 points. It has caused my blood pressure to elevate dangerously high as I have had to put in far more overtime than I would otherwise had to put in trying to secure this problem. I do hope to get some assistance to get this problem resolved.

The bank cashed a stale-dated check almost 10 months old that I had credited back into my account. I did this after waiting 6 months for it to clear. When I paid my mortgage that month, my check bounced for insufficient funds, and they charged me a $35.00 fee. They claimed the check is good up to 7 years if presented. I used to work in banking, and I know it does not cost them $35.00 in expenses to handle an overdrawn account.
I had to scramble to cover the difference in the account as well as fees and to make sure no other checks hit the bank before the fees were covered, or they would return them and charge me an additional $35.00 each.

My experience is similar to many of the other ones listed here: predatory overdraft or unavailable funds fees. I had overdraft protection in place. I got behind on payments at one point, but was CURRENT on the overdraft line of credit (i.e. Visa) when this occurred. I overdrafted by $40 on Thursday overnight (note that when I checked my balance at an ATM Thursday night at about 8 PM, I had $130 dollars in my account). Friday morning I was $40 in arrears. I made a deposit on the following Monday, by which time I had incurred $245 in overdraft fees - for FORTY DOLLARS in overdrafts!
When I complained that I had overdraft protection in place, I was told that when I got behind on the payments, the overdraft account was disconnected from my checking. I was not informed of this. When I got current again, Wachovia did not reconnect the accounts. When I placed phone calls, the banking side blamed the credit card side of the company, and the credit card side of the company blamed the banking side. A few hours after I made my complaint, I received a very terse phone call from someone who was obviously reading a script, and said all they could do was refund me $25. So I am now closing my account. I feel powerless, and my frustration and reasoning seemed to mean nothing to the customer service rep who called me. Wachovia had a number of things on hold from my check card, and put the largest one through first, which gave me a negative balance, and then put the smaller ones through individually so they could charge the fees for each one. When I viewed my online statement, the first transaction that put me in a negative balance was a $70 overdraft fee from Wachovia! It was dated Thursday night, and the rest of the overdrafts and fees were dated Friday - the next day - including another $175 in overdraft fees. I had heard a lot of bad things about Wachovia, but was willing to try them out since they have branches everywhere and I travel a lot for business. But after this experience, I will not ever do business with them again.
Consequences? I suffered $245 in fees that I can not afford. Not to mention stress, and the time it took me to go down to the branch and straighten it out (unsuccessfully).

Today I received an email from Bank of America saying they put my balance to below zero and are going to take my direct deposit check on Friday. I simply deposited a check I received from the State Treasurer's office, and they made it available. Then 5 days later they said they returned it to the Treasury. I need help a.s.a.p.
So far they are charging me $95 for overdraft charges. I also have direct deposit going to this account which they say they will take. I also have direct payments coming out of this account. This has caused me to be sick all weekend with this unending mess up. Please help.

Deposited a check in the amount of $400 for a car I sold on Ebay. The buyer is located two hours away. After the money had shown as cleared online, I spent the money. Two days later, my account shows as over $1200 over-withdrawn.
I called Wachovia and was told that somehow after the branch marked the check as received, they lost the physical check. So they had to take the $400 back out of my account, along with an additional $400 to cover the check. In doing that, they caused several other transactions to bounce.
I was told that I would need to contact the person I recieved the check from, have them cancel the previous check and issue a new one to me.
When I called this person and explained this to him. He told me that his bank would charge him $35 to cancel the previous check which he would have to charge me and the bank would only repay me if he gave them a letterhead stating that they had charged him.
So, now I must take off work on a weekday, drive down to him 2 hours away, go to the bank with him, get the letterhead, go to my branch, get re embersed for the cancel check fee. Fight over what charges I can get re emberssed from due to everything bouncing and close my account.
So far it looks like roughly $300 in overdrafts which I may be able to get back in time. Plus the lost wages from having to take off during banks business hours. Plus $40 in gas for driving to meet this guy. I also received bad feedback on ebay due to not being able to pay for an item I had won. My powerbill is late due to not being able to access funds. They need to realize that not all of us have extra cash in the bank to cover their mistakes. Estimated loss, over $360 for this $400 check.

I recently was charged $175.00 in unavailable funds fees from Wachovia. This was the result of a check posting to my account that put the account in deficit. However, Wachovia decided to post this check in favor to several smaller transactions that had been in hold status while the account had ample funds. Once they account was overdrawn, they put through these smaller transactions, each of which incurred a $35.00 fee for unavailable funds. One of these transactions was actually an ATM withdrawal. How could the funds be unavailable if I already had them in hand? I would like a substantial amount of the fees refunded to me. I really just think someone should look into this very suspect business practice. It is criminal.
I am a single person living on a moderate budget. This type of tax has quite an impact on my month.

There is no way I signed up for Credit Protection Plus. After digging further, Bank of America uses a third party company called CIC which administers the plan. I was charged two big fees before realizing they fraudulantly enrolled me in the plan and the last charge pushed me over my credit limit which alerted the credit bureaus that I am over the limit.
I'm currently fighting with Bank of America to get back the fees charged and get them to straighten out the over the limit notification to the credit bureaus.

I have a checking account with Wachovia Bank, and use a debit card to charge purchases. Last year in June, my account was charged $88 overdraft protection for 4 purchases (biggest being $9). I called the back at the time, and requested that overdraft not be allowed on my account. I was told that it would ensure that my account does not go in overdraft.
On 11/12 Feb, my account was again charged $175 overdraft fee. The balance on the account on the 12th Feb (without making any deposits) was $178.78 overdrawn, out of which $175 was overdraft fee for 5 transactions. I complained to the bank that firstly, I opted out of the overdraft - so the transactions should have been denied. And secondly, no matter how they calculate the overdraft fee, charging $175 for a $3.78 overdraft makes no sense.
The bank said there are no opt out instructions on the account, and offered to refund $35 of the overdraft fee.
Banks have ridiculous overdraft charges, it is high time legislation was introduced to protect consumers.

I have banked with Wachovia for around 12 years. I really haven't had any trouble for the most part that was not self-induced, until about 7 months ago. Around August of this past year I really started getting hit with some crazy ODF numbers. I always just blamed myself....that it was something I was doing. I started really hammering down, checking my account daily, trying to keep a current balance, etc..
However, I could not make any sense of what was going on and continued to get ODF. After about 5 months of this and trying to figure out how this continued to happen, I did figure out that....yes, they are posting transactions HOW and WHEN they feel like it and which honestly appears HOW and WHEN benefits them the most in getting fees out of you.
I have been tracking this for months. I am fairly intelligent person and I still have been unable to concretely figure out the rhyme and reason as to how they are processing transactions. What is even more frustrating is when you call customer service or walk into the branch for some explanations..... they have absolutely no idea either. They cannot give you any explanation.
For example, I can be on the phone with customer service looking at the screen on the computer and the customer service representative is looking at something completely different, and further, cannot explain what you are seeing.
I have printed off several days in a row off the online screens. It absolutely blew me away at how every day the balances change, transactions shift, etc., sometimes 3 or 4 days back. Again, call and ask for a explanation.....answer is I don't know. My screen shows.....
Today I went on-line to check my account, once again I have $140.00 in ODF. After further investigation and a call to the bank, I still do not know what or how that is....first off there were only 3 transactions that went through since yesterday, the only 3 I had out..... and there was money in there to cover all three. When I look on my screen it shows the first 2 ODF are what overdrafted me, not the transactions, and then when the third transaction went through they charged me 2 more ODF. This makes no sense and once again no one at Wachovia can explain it to me either.....BIG SURPRISE!
The whole reason I came to this website was I hoping that there was a lawsuit somewhere, because Wachovia has got to be doing something illegal somewhere. If not necessarily illegal, then they are stacking all the loop holes they can in thier favor for them to benefit and most likely end up with some of your money in thier pocket free.

I have been with Wachovia bank now for 10 months. It has been a horrible, costly experience for me and my family. I found out today that my account is overdrawn by $912.97 and still have 2 transactions that they have on hold. We track our money real closely and our account balance was at $882 before the bank closed on Friday. They tell us on Tuesday that our available funds were only $712.92. With no transactions occurring between this time. Several times now they have held transactions to try and get ODFs out of me. I have called different merchants and have them tell me they have already posted this transaction. Wachovia will tell you that that is when they sent it not when it posts with the bank. Yet, when it suits them the transactions post almost immediately. Sometimes they hold them for over two weeks but your balance wont reflect the hold. Someone needs to stop them from doing this because people like me live check to check and now we don't have a check to live on this week.
It cost me $882 ODF's not to mention I live check to check. So now I will have to go a week without electricity. 2 days of food left and still other bills I'm not going to be able to pay now. Someone needs to put a stop to this.

I recently opened an account with Wachovia. I've been dealing with a Credit Union for many years but decided it would probably be best to have a few bank accounts. I made several check card purchases over the weekend. I also wrote a check for $2000. I check my account on a daily basis and when I checked it this morning I had an overdraft fee of a whopping $198! I called Wachovia to find out how is it possible to have an overdraft fee of $198. I was told that my transactions are processed from the largest amount to the smallest (even though a lot of these transactions have still not posted to my account INCLUDING THE CHECK FOR $2000). Meaning they processed the $2000 check first then all the smaller transactions next even though they are still on hold. It does not matter what order they come in. I received a $22 fee for each of the 9 transactions that was processed after the check. Many of these transactions were under $10. In all the years that I've had a bank account, I have never heard of something so ridiculous!! In addition I made a deposit yesterday that would have covered all of my transactions and they did not post it until this morning. I am closing my account with Wachovia IMMEDIATELY!

I was signed up for an Insurance Plan to which I never agreed; when I tried to cancel, they said it was taken care of. I was busy moving to a new area, and I wasn't aware the entire time that the Fee for the plan I never wanted was causing me to become overdrawn. Their own overdraft fees were further causing me to become overdrawn even more so; they kept multiplying until it got to $711+.
I lost money out of my account. I lost months' worth of Fees for a plan I never ordered. It ruined my credit.

On 01/16/08 a $3,100.00 check from a State Farm Insurance settlement was deposited on a regular BofA ATM machine. A week later I called BofA customer service 800 number to ask about it, only to find out that the check was never cashed because it was issued under my name as well as my boyfriend's name. I asked the banker to send me the original check to my current address.
It has been more than ONE MONTH after I initially tried to deposit the check. Bank of America loses my check. I ask BofA to send me a copy of the check, and I receive something totally worthless. I was then misled to believe that I could deposit an invalid document, then I am told to wait one more week after a month of waiting for the check. I WAS COMPLETELY FRUSTRATED WITH THEIR RESPONSES AND CUSTOMER SERVICE!
I am now behind on my credit card payments, utility bills, student loan bill and medical insurance bill. My bills are pilling up, and my credit card may file a claim against my credit report. If I don't get this check cashed soon, my situation will worsen, and my credit will be severely affected. I need serious help to sue BofA of moral and financial damages that this has caused me.

I am getting really tired of Wachovia telling me when I often ask if the deposit goes in first before any deductions are taken out of the account and I get the same answer of Yes however that is not the case.
It seems that Wachovia's practice is to make all deductions and then deposits, this way they can get all of their NSF fees and make money off of the patrons that bank with them.
I recently liquidated some assets to pay off my house and received a very large check. I went to Wachovia and asked them if their would be a hold on this check and they said yes. Naturally I thought it was because of the size of the ckeck, but, found out this was not the case at all. I asked how many days that the hold would be for and the teller told 7 days. Well this caused me to miss my payoff date therefore, it has now cost me more money to pay off my house and get another payoff draft summary.
After I received my deposit slip I noticed outside the bank that the hold was not for 7 days but actually for 10 DAYS!!!! I went back in and confronted the teller and she said that they did not count the day of the deposit even though it was made at 9:00 AM and they did not count the holiday or weekends.
The reason for all of this was given on the deposit slip as We are delaying the availability of the funds you deposited as indicated below. We are taking this action because: You have overdrawn your account repeatedly in the last six months. This is the reason they have given me to hold my payoff check for my home. I understand it is every businesses goal to make money but, making money using unfair banking practices is going to far.
Last year my son, who also banked with Wachovia, who is in the military and is stationed in Washington State closed his account and suffered at Wachovia's unfair banking practices. Wachovia does not have a branch where he is, so he gets charged an outrageous amount of money ever time he used his debit/visa card. The amount he was charged was $25.77 every time he used it. When he would inquire how much he had in his account it always showed a positive balance. He would use his card and then get charged multiple NSF fees. His fees every month since he has been there has been totaling almost the same as his paycheck.
One time he was not able to pay his NSF fees all the way down, so Wachovia being the great rip off's that they are went after mine and my husbands account since I was a second signature on my sons account and they removed with prior notice the amount that my son had over drawn to a whopping some of $140. I could not figure out where my money went to as I had NO prior notice. This caused my electric bill, mortgage and water bill to bounce, which Wachovia was ever so happy to charge me $35 for each NSF.
I later received a notice 1 week later that they were pulling the money out of mine and my husbands account to pay my son's NSF's. I am going to be closing my account with Wachovia. I have been lied to and cheated out of my money. I will not EVER recommend them to anyone. My account has never been accurate. My legend has never matched theirs, there is always a difference. No one at Wachovia is helpful, and it is always my fault. I'm over it!!!!! And don't get me started with Country Wide!!!!!

In 1999 my husband and I were looking for a way to invest a lottery winning. Wachovia (First Union at the time) was more than happy to help us plan out our lives. We received so much support in investment strategies and oppurtunities for our future. We were advised to invest all of the money with Wachovia and take loans out against the money. Sounds dumb now, however, Wachovia showed us how our investments would earn more than the interest on our loans. Even if the markets were to change (which they did) we were building a long term relationship with the bank and that would work in our favor.
Our brokers came and went and our porfolio dropped about $300,000 over a 3 year period. Of course, when we complained, we were told not to panic because the long term outcome would not be affected. Our last porfolio manager decided that we should not be in the stock market any more, he sold all of our stocks in one day and put our balance into a money market account earning less than one percent. We were perfect customers. They held our investments ransom. We were told that if we renewed our loans for another year, Wachovia would release our porfolio back into a higher yilding account. We didn't have a choice.

I canceled an online payment for my checking account. It is the first time I ever did that and I was under the impression that the payment was canceled. Wachovia still made the payment and because of that I was over draft and charged two over draft fees for the total amount of $70.00. I called and complained about this information and most of the people that I talked to said I should have realized the payment was not canceled. My response is that when I did click cancel payment? A pop up said cancel payment? Okay and I figured that everything was fine.

I deposited 100 dollars into my Wachovia checking account through a Wachovia ATM. I wanted to make sure it was in the account so I called the bank. Money was in, good to go. I made 3 transaction that afternoon, wrote it all down in my register, then went online to their site to verify it all. suddenly the money wasn't there. I got hit will a combination of Unavailable Funds fees and Over Draft fee's. The fees cost more than the 100 bucks I put in the bank.
I was left with about 120 dollars in the hole after my fist 100 was to cover the overdraft fees, and I was still left with the purchases I made. I don't do business with them anymore.

I asked 15 days ago by letter for the transfer of my money in my French bank because I am now living in Paris. I sent also a copy of my passport and a piece of my blue card. Nothing has been done, and I have no way to communicate. The only phone number I have is an answering machine. Thank you to tell me how I can speed up the process and be sure it will be done.
The consequence is I am now without money to create the new business I have to create.

I was admitted to the Veterans Administration Medical Center in Asheville North Carolina on July 9, 2007. I was discharged on July 19, 2007 after receiving 3 units of blood, 1000 milligrams of iron and platelets. I was given a diagnosis by the cancer doctor at the VA hospital August 13, 2007. I was told that I had had acute myeloid leukemia for at least a year and had approximately one year to live. I was hospitalized again on October 27, 2007 at Park Ridge Hospital in Fletcher North Carolina. There, I received both blood and iron and was discharged November 5, 2007. I have credit cards with Bank of America, Household Bank, Providian (Washington Mutual) and Chase Bank. Although I had Credit Card Protection with all of them, ONLY CHASE BANK immediately deferred my payments with zero interest from the time I let them know I had cancer. I called Chase Bank; they gave me time to send proof of my condition, it was that simple!
Bank of America has referred my account to a collection agency! I have had a 60% military related disability for several years; however, since the diagnosis of acute myeloid leukemia, I am now 100% disabled. My medical and personal expenses have risen significantly, and I haven't been able to be as independent as I was previous to my first hospitalization in July of last year. I've been treated by a doctor who wrote a letter for me stating I was 100% disabled, which I sent to all the credit card companies/Credit Protection Agencies along with a pathology report. Since becoming 100% disabled as of July 9, 2007, I haven't used any of my credit cards, while continuing to make all my payments (with the exception of Chase Bank) through November 2007. During this time I was repeatedly faxing and mailing reports, and calling to inform the credit card companies and their Credit Card Protection Agencies of my condition.
Every day I'm STILL RECEIVING calls from representatives of the credit card companies. Sick people do not need people calling them from 8:00 am till after 8:00 pm, and even on weekends. My doctor says this continued pressure by the credit card companies is to stressful for me and is not good for my condition. Two years ago I sold my home. The people who bought my home defaulted on the first mortgage, and I lost over fifty thousand dollars because I had agreed to hold a second mortgage for them. Losing all that money did not create as much stress for me as the credit card companies/Credit Protection Agencies are generating for me at this time in my life! Thank you.

I have all but cleared out my account at Wachovia and only use it for business I can't do at My Credit Union 3 hours away. I am human and from time to time make an addition error. This time I was unaware that I had made an addition error. 2 transactions went through bringing me into the negative $7.02. Wachovia put through the larger of the 2 transactions first so the could access two $35 NSF fees. I immediately deposited $7.02 and called Wachovia asking them to waive the fees. The best they can do is now 10%. $7 out of $70. I tried to contact Ken Thompson the CEO of wachovia back in November to try to resolve another issue. His office would not reply. When I spoke to the people at 1800wachovia, they will not give out a phone # to there executive offices, but the will give an address.
It is more principal than anything else. How unethical is it to purposely maximize overdraft income. The day of my contact with Mr Bell, it was 2 degrees outside. I needed gas in my car, and I knew I only had 10% propane left at home for heat . Now I have to worry about $70 to pay Wachovia bank.

I am convinced that Bank of America is profiting from charging bogus overdraft fees. When making cash deposits prior to the cut-off time, I've been told it would post the same day only to find out they post the following day, which has resulted in overdraft charges. Also I paid $28 to do a stop payment on a transaction only to find out after they sent the transaction through and that it takes 3 days to stop the payment. There was nothing in writing stating this and the customer service rep who helped me never mentioned it when I paid the $28, which was deducted from my account immediately. Then when I called customer service, they told me there was nothing they could do; but, valued me as a customer.
I have lost over $200 to the bank of america in overdraft fees alone because of misleading information from the bank. I'm a single mother with two children and I can't afford to give away that much money, especially when I feel I'm following the necessary procedures to keep my account in good standing.

I opened a checking account online with a savings account. Months later BOA converted because of to many withdrawals. I understand the change to a checking due to the issue. However, they convienently forgot to switch the automatic savings plan off since it was no longer going into a interest bearing savings. This has caused many headaches for me.
First, I had enough money to cover a payment for a purchase I made with this feature they forgot to take off with the switch they charged my account a NSF fee and trans fee of $10. I went back through my records and BOA did this to me on multiple occasions. They said it was my fault because I didn't notify them and would not refund any of the money. The estimated total last year had to be over $100 in the $10 fees and almost another $100 in NSF fees. When I complained they said it was my fault. I asked if they converted the account why didn't they take that feature away since it was not a savings? They replied it is my responsibility to tell them. I find that somewhat amusing seeing they made the changes to the account and never told me I could have the keep the change savings on a checking account. I know you might think why did I not notice this sooner and it is simple, $10 leaving my account at a time I just didn't notice, but a deeper look into my account upon the year review I find out. I was also told if I replenish my account the same day prior to 2pm I would not be hit with NSF fees. Each time I have done this they have denied my request. I currently have 1 investment account with BOA, 3 Checking. Out of all the banks I have banked with Bank Of America has the best service to your face but lacks delivery
Because of this I am now short my car payment and is adding much undo stress.

Bank of America wiped out my checking account, without my authorization. My daughter, not on this account, was a counterfeit victim, she cashed money and the bank used my funds to cover their loss. However, she is not on this account, I did not have anything to do with it. I'm 83 years old.

Everything that I have read on this website about Wachovia is so true as I had it happen to me repeatedly over the past several months.
I opened my account with Wachovia earlier this year because of its convenient location to my home (1 block away, if that)
Anyway, I already had $450.00 just prior to having my Social Security Disability Check of $813.00, as well as my kids SS checks of $137.00 each for a total of $1087 combined equaling $1,537.00 and then right after that my husband's unemployment check came in for $444.00 for a grand total of $1,981.00. I went in to Wachovia for a cashier's check in the amount of $850.00 for my monthly rental which, when subtracted from my account, equalled $1,131.00. I went grocery shopping at Walmart and used my debit card for $200.00 for groceries which should have left a $931.00 balance!!
Well the next day, I looked at my account on Wachovia.com and found that they did not give me credit for the 3 direct deposits that I had from SS. I called the representative at Wachovia and was told that depending on when the direct deposits came in, they have the option of holding them for a certain time period and that I shouldn't have spent the money until I was sure they were credited. I couldn't believe it!!
I thought that when a SS check is direct deposited, it was as good as cash. They nd I charged me $35 for each transaction that had come in somehow totaling $656.00. Come to find out that they canceled the cashier's check for $850.00. I still haven't got a valid answer for that. Anyway, I'm now out quite a bit of money and have cancelled my account with Wachovia. I will never go back to that bank.
I am out a fortune in NSF fees, no money to live on now, and the embarrassment of being told very loudly that I need to learn how to manage my check book!! This was embarrassing when I didn't do anything wrong.

They have refused to return approximately $30,000.00 that was fraudulently taken from my handicapped, bedbound, and now deceased mothers accounts with them. I have sent them proof of this, the names of some of the people who did it, which I had to investigate on my own while grieving the death of my mother since Wachovia was doing nothing about it., copies of the checks along with some of the peoples arrest records, which include FRAUD.
I even have an eyewitness, a store owner who identified one of the people who fraudulently used my mothers debit card in her store several times. The person I was told who was in charge of the fraud department (Maralyn K) first refused to even speak with me when I initially called. I had to get a news group after them before she would even get on the phone with me.
On about my thirtieth call to them one of Wachovia employees told me that this woman (Maralyn K) even accused me of being in with the people who stole this money from my mother.
When I finally spoke to this Maralyn K, I asked her what Wachovia was going to do about this and the main question she asked me was Well, that depends on how much money we are talking about here.? My first thought was why does that matter, there are numerous fraudulent transactions on my mothers accounts and they need to pay the money back. The amount should have nothing to do with them doing the right thing. Well, it did.
They decided that keeping the money that was taken from my mothers accounts was more important then having a bad reputation. They sent me in circles for months then came back and told me they would not do anything about it. They would not return the money and they have not prosecuted the people who did this. Let us show them the power of the consumer and boycott Wachovia Bank until they pay this money back!
My plans to buy a home for my family are gone. Money that was going to go toward my 2 year old daughter's college is also gone. My anxiety level has been sky high and I can't sleep much wondering why they are treating me this way and what I can do about it.

I used to work for Wachovia for over a year. I left after two weeks notice. Apparently, they figured I didn't deserve the last paycheck I got by direct deposit. They took it back after I had spent most of the money and was still in the positive. When they took it back, they put me in the negative and gave me overdraft fees for about twenty or thirty check card purchases. The lady I spoke to at the 800 number refunded about one or two hundred dollars, but that's it.
I was left about $1000 in the hole, and am now in their recovery and chexsystems, so that I can't open an account at any bank.

I made a deposit of 731 dollars into my account which has now disappeared. I contacted the branch and they have no clue what happened to the deposit and they weren't going to take further action until I showed them a deposit slip. Luckily for me, I save these slips just in case. Now, they have made an investigation even though they can clearly see the deposit isn't showing and I have proof of this deposit. I am waiting for a check to go in for my rent and I am totally worried because they are taking 24-42 hours for the investigation. How can this have happened?
I still need my $731 to be posted into my account otherwise I might get a 3 day notice and a bounced check on my car payment.

I signed up for a checking account on Nov 30, 2007. A bank representative offered me a credit card with BOA which I took. At NO TIME did I agree to Credit Protection Plus which was somehow added on without my permission. I was billed approx $90 per month. I have been out of town for 2 months and paying my bills online therefore did not notice the charge for over 60 days until I saw the actual statements. Neither Credit Protection or Bank of America will refund the money that was stolen from my account without my authorization.
I have spent time and money - cell phone bills, time from work, etc trying to resolve this issue. I even contact corporate headquarters of Bank of America. BOA says there is nothing they can do. I cannot believe this company has been allowed to steal from me and no one will do anything about it!!

We closed all our accounts with Bank of America in Oct. and Nov. of 2007. This includes all checking, savings and visa accounts. On Friday, Feb.1, we received a letter from Keith Palmer stating that he had in fact closed one of our accounts due to a history of delinquency with our creditors. Not only have we had to literally fight to close our accounts with Bank of America, but now we are receiving mail that in fact slanders our name and credit rating. The letter gives no dates or proof. This sort of treatment has been going on for some time, and we are feeling not only slandered but feel they are in fact harassing us and our good name. We have the closing receipts showing the dates all accounts were closed. The letter received from Keith Palmer is dated for Jan. 24, 2008--clearly after the date that all accounts were in fact closed by us.
This constant treatment is causing great stress and despair. We are feeling threatened by this constant harrassment and the possibility that they could damage out credit. We don't understand how can this sort of treatment go on in this country?

Ihave noticed that Bank of America charged me $350 in overdraft fees because they charged out first from the big amount and them the small amounts, to make you fall in overdraft fees--even though you have spent small amount in the morning and the big amount after 4 pm. For Bank of America, it is when you withdraw money from your account after hours (4 pm), they won't count it for next day transaction; but if is a deposit after hours, they will credit it on the next day transaction. That is how my account falls on overdraft.
These frequent overdrafts are causing economic problems. I thought Bank of America will base it on the interest of their loans--no, from billions of dollars they charge their loyal customers.

I placed a stop-payment order on Wachovia's website on Jan. 21. It was payment for COBRA health insurance coverage that I was informed, two months after the fact, that I did not have. On Jan. 22, Wachovia charged my account its $30 stop-payment fee. On Jan. 23, Wachovia honored the very check on which I had placed a stop-payment order. Wachovia refuses to credit my account the amount of check, and worse, refuses to refund the $30 stop-payment fee.
I am out over $460 that I cannot recover. Wachovia did not honor its own policy, which I have quoted to them verbatim from Wachovia's own website.

I opened a online CD after seeing an ad in Bank of America website for APY 4.85. However after signing up, the bank gave a rate of apy 4.75%. My complaint is about the time taken to reach a customer via telephone and their ability to resolve the problem. On the first attempt I spent nearly 50 minutes and gave up. Because they transfer from one dept to another and so on. And at one point, the system disconnected. BofA ask so many questions in the name of verifying my identity and finally that guy doesn't resolve, again goes to another dept. I did a simple math for the interest amount that I will lose on a .1% which is about $8 for 4 month. So I decided to give up instead of wasting my time. On a different note, I want to notify them about the maturity date and it is so far taken 20 minutes to reach them, so has to disconnect. Poor Service. I will not choose BofA in the future and eventually I will close all my business with them. Another funny thing they provide in the cd receipt of associate phone number as 800-432 1100 which takes to a bad entertainment line.

I went to Bank of America to cash a cashiers check I received for $4,000. I asked the teller if there is some way to verify the funds, or verify the check. The teller said this is a cashiers check, it is guaranteed funds--meaning there is no way it won't go through. I depended on the teller's promise to me that there is no way there will be a problem with the check. I wrote a check back to the sender of the $4,000 for $2,400, and found out that the check was later canceled as fraud. (I later find out this is a huge scam.)
I never received my $4,000, and the Bank of America teller TOLD ME it was guaranteed. I want them to be held responsible for this, as I was suspicious: but when they assured me everything was fine, now I lost $2,400.

On Jan. 16 I unintentionally overdrew my account by .93 cents. The next day I deposited $140.00; however, the damage was done. I have received four $35 charges totaling $140. I am presently overdrawn by $53.34 and have no way of catching up. I was told to take a register because I don't know how to count.
Instead of having money in the bank I am charged $140--at a time when I am just returning to work after being laid off for 2 months. I do know how to count, and charging 140 dollars for a 93-cent mistake is criminal.

Recently I accrued a total of $155 in overdraft fees. The first overdraft fee was posted before a negative balance was shown. If you add the overdraft fee to the available funds, the next charge would have cleared with money to spare. After contacting Wachovia I was told that this happened because other purchases that were on hold? had amounted to a larger sum than the available funds. Three subsequent overdrafts ensued the following day. Realistically, two more should have occurred based on the sequence of purchases. I say two more because of the largest to smallest processing these banks are allowed to conduct.

I had 2 cd's mature in Jan. One on the 12th, one on the 19th. I called on the 12th to have money sent to me. I called again on the 19th and asked also about the one on the 12th. Told they could not mail it as they had a po box. I gave them my address. They said both checks would go out express mail, no charge. Then I got an email saying the check from the 12th went out on the 14th! They cannot tell me where they sent it for sure. It is the 25th and still no check. I learned from them that their normal practice is to mail those checks out 3rd class mail, 7 to 10 business days!! They keep your money tied up in their bank for longer, by not using 1st class mail, or they want you to pay $16. for express (which they call 1st class) 3-5 days.
I lost interest and had to take money out of another account to pay for another CD within 12 days. So I lost interest on over $20,000 for all the days they have had it plus the time it takes to cash. They should send peoples' money back at least first class. This is a ploy to keep the money longer and they make the profit.

I have incurred $105.00 in overdraft fees when my account is not overdraft. They are charging me on pending charges from my debit card that have not yet posted from the merchants. How can they charge fees on money that has yet to change hands? If the account is not overdraft - how can an overdraft fee be charged?
I am unable to pay for necessities this week.

Wachovia is a very sneaky bank in my opinion. I believe that they have a policy that they process the highest or most amount of money that you spent on a check card. I fell victim to this very sly way for gaining another dollar. I had deposited $31.22 in my checking account. I've come to this website before and I knew that the Online Banking that Wachovia has is somewhat delayed in the time that the information is processed. So after depositing the amount the $31.22, I waited 3 days for the money to be processed. Soon afterwards, I made two purchases online, which brought my account down to about $5.62. After going online, I saw that it had been correctly deducted from the account. So, I make another purchase, which I end up overdrafting on only 24 cents. To balance that, I deposited $5 into my checking only 2 hours apart from when I overdrafted. So the next morning, I see that I have overdrafted $22 two days ago! Apparently, when I deposited the $31.22, I seperately withdrew $18 dollars and had $12. Then I overdrafted somehow, which put me in by $22 and the next day, I put $5 into the account first. THEN spent more money on the next two purchases which gave me even more overdraft. The total owed was $85 by the end of the day. So my question is, how could I overdraft, when I apparently spent $18 from $31.22? And yet, the representative I spoke to said that I only had $12 and that I spent over that.
I only had to make a huge loan for the $87. But being a freshman college student, I don't have enough time, nor energy to come up with $87 in a day. I am starting a new job and since no money is coming in, who knows how much more I would have had to pay. I will definetly NOT recommend Wachovia bank to any of my friends or family. I will also tell a close friend of mine to get out of a Wachovia account and move on to someone better. I won't look at banking the same again and being as young as I am, this will definitely affect my decisions in life.

I had made a payment to my car insurance company with my check card from Wachovia and about an hour later went online to Wachovia to check my account and to see the balance. After I had made the payment to the insuance company, I had a remaining balance of just over $100. That was on the 20th of January. On the 22nd of January I made a deposit of over $350. In between that time a few check card purchases were made each not exceeding $10. Just before leaving the house to go grocery shopping on the 25th of January I go to my online Wachovia account which to my complete shock says that I have a balance of $58! A fee for $4 for a non Wachovia ATM withdrawal and a $140 overdraft/unavailabe funds withdrawl is showing on my account BUT when I check my account and ask for a listing for all ATM withdrawals it shows no ATM withdrawals! How can I go from accounting I have at least $400 in my account to the online account showing I have only $58 and withdrawals for overdrafts and ATM fees that I have not done nor should be charged for! My husband and I are so upset and as of today we are closing our account with Wachovia.
The consequences were that not only we couldn't buy the groceries we needed and the over the counter medication my 4 year old son needed, but we will also did not have the funds available to pay our utilities on time. We are on a tight budget having just moved to the States and as of now only my husband has an income.

My personal checking account was debited $5600 without any notification because they stated that my husband owed a balance of B of A credit card. I asked what that had to do with my personal funds and was told his social security number was traced and his name was added to my account.
I pulled the signature card because I did not personally added him to my acct. The rep stated that it looked like my handwriting when it was clearly obvious it was not. How can someone come inside a branch and add a name without the account owner present?
I asked them to return my funds because firstly, i did not add him to my account and secondly my name was not on his credit card application as joint. This happen 12/31/07, and they keep giving me all these crazy reasons as to why they feel this was appropriate.

My husband and I have our business account with Bank of America. On Jan 15, 2008 a $867.24 check was debited twice from our account. I called the bank and the customer service rep said she filed a dispute and the money would be credited to my account in two business days.
I called again on the 18tf and the rep said it would be credited on the 19th. I was told on the 19th that the first rep was incorrect and that it takes 2 to 5 business days. I told them that I wanted to know the exact date that the money would be credited. She said it would be no later than the 24th of January.
I am very confused about this situation. Once the bank made the error on the 15th, it should have been immediately credited.

I went to Bank of America to cash my paycheck (as I do every two weeks). They handed me a counterfeit $100.00 bill, and of course I did not realize it until I tried to use it to pay a bill. The person I gave the money to, retained the bill. I went back to Bank of America after realizing what happened and their answer: Sometimes that happens!
WHAT? Do they not have a way to check their bills? This is ludicrous! This may not be a lot of money to them, but I am a retiree on Social Security and certainly cannot afford to lose a penny, let alone $100.00. They acted as though, "so sad, too bad". I just simply want people to know that their common practice is not to check their bills!

A few months ago I noticed that Bank of America's billing system was putting the due date on the weekend. However, their online payment system will not allow you to use a weekend date. I called after the January payment was credited to my account on the 14th to ask that the late fee be removed. I was told "No, we are not going to do that." After an exchange with a rude customer service rep, I asked to speak to a supervisor. The rep told me "It will not do any good; she is not going to remove it either." At that point I informed her that I wanted to report her bad attitude; I'm still waiting for their call.
My problem is the due date always seems to move to a weekend date, and I should not have to pay the bill early. If their billing system will use a weekend date, their payment system should also use it. I beleive that it is just a way to get an additional $39.00 out of their customers. Luckily I have been able to surf almost the entire balance to other accounts to get BOA out of my life forever. They are legally allowed to steal from their customers in the form of fees.

Bank of America just loves to complicate things. Their online bill-pay service is intentionally misleading and deceptive. I paid someone $150 with this service. It was set to be delivered on a specific date. On that day the website said it was sent, and the funds were withdrawn from my checking account--except they weren't. I noticed the balance had not adjusted. I called the 800# to ask about it, and they said they do not withdraw funds for at least 24 hours. But that's not what bill-pay said; bill-pay said the withdrawal was made the day the payment was delivered, nothing about a delay. If I had not caught that I would have spent money that was already spent.
There can be no reasonable explanation for this other than BOA hopes to trip you up and nail you with overdraft fees. It's the same reason online banking is as ridiculously complex as it is--with pending charges and delayed deposits; nothing is in real time. The balances you see are never the actual balances. It's like everything they do is oriented toward pumping more outrageous penalty fees out of you. What ever happened to honorable business practices? BOA is more like a slipshod bazaar.
