    i was going into debt and they were the only company who would not work with me on payments they flat out refused the partial payments i could make, they called me everyday asking me for the full payment and when i could pay it. after numerous times i've tried to explain my situation they would't help me the harrassment didnt stop. now they are gonna repossess my car and ruin my good credit and there's nothing i can do. they told me to pay $900 by the end of the week or they take my car away. i don't know what to do, i called citi bank and they couldn't believe what they did.

    They have cause me mental and emotional stress. I'm going to have my credit ruined and i don't know who will approve me for any loan now. There was nothing I could do or say to negotiate anything now it's going to look like i avoid payments. I've had anxiety attacks due to their harrassing calls everyday, i stopped answering my phone. No one deserves to be treated like this under any circumstances.

    I called 9/11/08 to place stop payment on a check. I gave all necessary information and was told it had been completed. Today I have 7 overdraft fees because the Customer Service Rep did not place the check number on the stop payment. I contacted a supervisor and was told it was valid charges because I wrote a check to a merchent and it as presented by them in good faith. Is there anything I can do about this?

    I deposited 10000 some odd dollars this past friday, only to be told that they have to put a hold on the check which i kinda expected. They allowed me to have 2260 of the 10000, so i went on spending like most of us do, i check my account balance more than 5 times a day. So when i checked it today it said i was overdrafted 343.and somne change so i called the bank customer service could not help me, so i went into the branch and they told me that it was my fault for not keeping track of my tranactions. Which i do.

    anyways they [took] 225 dollars which im trying to get back because it was their fault. They take the bigger check card purchases and prosess them through and leave the smaller amounts like $4.67, and $5.68 and charge an NSF fee. which ends up costing the customer hardship. I want to close my account but they wont let me.

    I was going to use that money for school but it looks like i cant now, they've messed up my whole life.

    I have been a BOA customer for a number of years I do all my baking onlie except for cash and personal check deposits. I have recieved NO statement for over a year. I figured that was because I was online I just did not get them anymore. ANYWAY I just recieved 5 OD charges for 35.00 each! ON PENDING NOT POSTED TRANSACTIONS!

    My daughter who is 18 had an account with wachovia. My daughters account was overdrawn and wachovia did not notify me that they were going to take the 481.00 out of my account. they just took the money out my account and overdrew my account making me have several hundred dollars in overdraft fees. I called customer service in which they transferred me to the recovery department that processed the transfer of funds from my account and unfortunately Irene said I can't help you, you need to speak to customer service, I explained to her that customer service transferred me to her because her department did the transaction.

    I was then placed on hold for 30 minutes for a manager and the manager finally came on the line and said she would look up the account. The manager never came back to the line and took my information and hung up. I am giving up on banking.

    I have a total of $250.00 worth of insufficient funds fees on my wachovia bank account right now, and they are going to stay there until someone can explain to me why wachovia thinks its their decision on when my purchases should be put through on my bank account. Instead of my purchases coming off of my account by the date I actually made the purchase, wachovia decided that they think the biggest purchase should be put through first.

    If you asked me I would say its obvious that wachovia is trying to make as much money as they can off of people that live paycheck to paycheck by charging them fees anytime they see a chance! If you ask someone at Wachovia the same question, all they would be able to tell you is that it's their policy. And thats all you'll get from them. This is a big scam that Wachovia is managing to get away with. So long Wachovia.

    I found out that Wachovia can charge a person (2) ISF fees for (1) ISF transaction. The telephone representative explained to me that when a purchase is made and the funds are not available, Wachovia charges a $35.00 fee against what is called the posted funds. About a day later Wachovia charges another $35.00 ISF against the available funds for that same ISF purchase when the transaction goes through.

    The telephone representative tried to explain that the 2 acounts (posted and available) are different and that if money had been put into the available funds account before the transaction went through, then I would not have been charged for the 2nd ISF on that same purchase. If that's the case, then depositing money into the account to cover that transaction would void both fees.

    The telephone representative did not agree with this logic. Instead, she told me that I should keep and accurate ledger of my own. How can I, if I don't know how many times I will be penalized for 1 transaction?!?!? She then pretended that my phone was breaking up and couldn't hear me anymore. This sounds like the biggest money making SCAM I have ever heard.

    As a result, I was charged over $300.00 in double overdraft fees for purchases that didn't even add up to $100.00

    I have been a B of A customer for many years, over the past two years they have gotten out of control with their fees. Not only do they charge me to DEPOSIT money into my savings account (any more than 4 deposits a month is a $3.00 fee) but now they have resorted to changing the days of transactions and therefore causing overdrafts on my account. I have a statement which clearly shows that at no time did my account become overdrawn yet I incurred a $35.00 insufficient funds fee. When I went to the branch to question this charge I was told that I can not go by the online banking statement because it is not accurate and their computers show that the charge was incurred one day prior to my deposit. When I showed them the statement showing them that the charge did not occur on 9/10 but 9/11 when two large deposits were made they refused to acknowledge the online statement and said they could only go by thier computers.

    They are falsely advertising that you can check your balances via computer or phone since the information that you access is obviously useless and no B of A customer that I know of has privledges to access their bank account information. This has gotten out of control, the customer service reps are RUDE, dismissive and have told me to learn how to keep a check register. I don't care how many check registers I keep, if they keep changing dates of transactions it doesn't matter what record keeping I have, they will always be right and keep taking my hard earned money.

    I am a single mother of five children. They are taking my child support that is direct deposited into their account. They should be ashamed of themselves. I have photocopied my statement and have sent it in with a consumer complaint to the Attorney General here in Connecticut. I have already contacted Child Support Enforcement to have my child support direct deposited into a local bank and as soon as that goes through my checking, savings and all five of my childrens savings accounts will be closed at Bank of America. I have had enough of them using my hard earned money to pad their paychecks with. I will tell anyone and everyone how horrible that bank is, not that it will do much but if it keeps one person from being sucked into their banking scams then it is worth it.

    I am now short on the payment that I had set up to be paid via the internet. My childrens savings accounts have been raided of their birthday money and my savings account has been depleated to cover the bank fees. I have lost time to hang on hold only to be disconnected. I have lost pay to fight with the representative at the bank to no avail since I couldn't get anything resolved over the phone. They have caused other checks to be overdrawn since they randomly charge you fees based on their records. I have to check my account daily to see what new fees they choose to tack onto my account and even that obviously doesn't help since they can rework your transactions to thier benefit when they choose, and the online statement is not accurate - which comes directly from the mouths of their own representatives. The aggrivation and loss of funds are not worth any of the conveniences they offer.

    What happened? That is what we would like to know. A payment that is one day late results in a $39.00 fine and raising our interest rate to 29%. This is a legal form of loan sharking. Housing crisis? What about this crisis. I have a credit score of 725 and am looking to find a reputable bank to transfer this account to. Even when you pay early, they tell you that is wasn't in the billing cycle and charge a late fee. Please help!

    Unless I find another company to transfer this to, all I am doing to paying interest every month.

    For the past yr I have ripped off time and time again by wachovia. I have direct deposit and my check goes in the bank thursday morning at midnight. I have sat online and at 11:59 i had zero overdrafts, Then at midnight i will have $200 in overdrafts? How can [they] continue to rip off the working man/women?

    And then when you call and complain they give you back $70. If i`m the one that is overspending, If i`m the one causing overdrafts then why in the world would they give me money back if it`s my fault? Hummmm. I just got something called Order to Hold for $170? If anyone knows of a class action lawsuit in progress let me know. If not lets start one.

    I lost my place i lived, I go sometime with no food. Gas is $5 a gallon here in KNoxville I`m so stressed out about this that my health is declining.

    I Had a very hard accident a year ago. I couldn't pay my mortage or any other bills and now have a better Job and they won;t work with me to help me pay them . They want all or nothing at all . I have 4000 dollars and they won't take it. And that is almost the whole balance and they won't take it.

    I am sixty one years old , have pets, I am worn out , ready to walk away from it. I am working full time and trying to pack. Daughter having trouble with a pregnacy, mother gravely ill. Don't know wheather I am coming or going , lived here for three years and lots of stuff to liquidate and I have offered the bank 4000 dollars and they won't take it . It is all or nothing at all. No one can figure the problems out. Angency wont work with them . Bank of Amercia won't work with me on this. Had a bad accident and was out of work for awhile.

    On August 19th I closed my Bank of America Account. Zero balance. On sept 5th I had an automatic non paper transaction come through. Bank of Amercia REOPENED! my account and made the payment! How can a company open an account and pay something from a closed account. They said that since they had my account number and routing number that they had the right to pay them. I did not know that Bank of America supersides any authroity when it come to desiding that even if the account was closed for 2 weeks, they can re-open it to make transactions because someone has your info.

    I closed this account; Now they want to charge me on something that came in 2 weeks after the account was closed! THe Account was closed on August 19th! I went in personaly and closed it!

    Im stressed out and sick to my stomche about the whole thing!

    i ordered a disk about making money on creigs list that came through the mail and was satated the for 1.95 i would get the infomation about this. didnt recive disk and later on the 8th of september i found a charge for 39,85 from Online Business Servives. I called Bank of America and asked them about this charge and said it wasnt authorized (didnt know who this was). bank of america said i had to let it post and had to call fraud.

    I tried to cancel this transaction, but they wouldnt let me do so...it now posted to account and brung other charges in the arrears...3...when i called Bank of America and complained about this and asked about this they said that they would investigate the matter and refund money till matter settles...now i ask you this question....why didnt BoA cancel said transaction when i called them 2-=3days before said transaction posted to account instead of letting transaction post and me going through said aggravation....why

    up in the air...BofA standing behind said belives that they cant cancle said transition....the other company saying that there was an monthly service charge when they didnt state in the intrum about that and didnt recive disk...so you tell me....why do i have to step up to the plate and say i will pay said bills when said bills are not revieled....

    i recently opened an account with bank of america, what a mistake. they can actually put a hold on YOUR money. i work very hard but its difficult to pay bills when a bank want to control every dollar. i think this kind of service is obsured and bank of america needs to realize they are not in control of me or my money. i will for sure close my account with them as soon as i can.

    their poor customer service lacks with empathy and concern all they can say is im sorry and explain their text book reason. very very bad customer service i would not recomend anyone to this so called hitler style process. i hope someday soon this bank will fall and it will as long as they keep oporating with this style.

    lost ALL personal belife in any bank it will take alot of conviencing for me to open another account i will cxl my account pay my bills only by money order and never trust another bank EVER.

    We check our account on-line almost three times a day. On Friday, my boyfriend deposited his check into our account at an ATM at 4:30. He printed out the receipt to make sure it was deposited. He then printed an account balance slip. It stated we had 176.00. We have been depositing his checks every Friday and every Friday they give us 100.00 and then deposit the rest of the check on Monday. Understandable. Knowing that we had 176.00 he withdrew 80.00. I checked our account that night and we had one hold and the rest of our transactions had been taken out.

    The next morning I check the account and there is 70.00 in overdraft fees. I call and ask about it and the rep. I end up talking to me tells me I need to pay attention more and then hangs up on me. I call back and a nice woman talks to me but is still unable to tell me why the fees took place. She said that the 80.00 was taken out, then two transactions took place and then we were credited the 100.00.

    That doesnt make any sense at all because I am looking at the slip from the ATM that tells me I had 176.00 before the 80.00 was taken out. If I go in Monday and show them my receipt and I dont get my money back they are going to lose a customer, a loyal one at that.

    I check my account everyday to make sure things are ok. Today I check my acct and find FIVE overdraft fees in the amount of $35.00 each. I go back through my online statement and find nothing on my part that constitutes these fees, so I call the useless 1-800 number provided. I was told that even though my money was in there, and the charges for each of the debits had cleared. I had made two deposits the day before and the day after, and was still told that it didn't matter...they were pending charges and warranted the overdraft fees.

    I AM BESIDE MYSELF AS TO HOW THIS HAPPENED. I HAVEN'T HAD AN OVERDRAWN ACCT IN SOMETIME AND I THINK THIS IS ABOUT AS SHADY AS IT CAN GET. I HAVE PRINTED OUT MY STATEMENT, AND TAKING IT TO MY LOCAL BRANCH, HAVING THEM REFUND THE FEES...AND THEN WHEN THEY ASK ME IF THERE IS ANYTHING ELSE THEY CAN DO FOR ME... MY ANSWER WILL BE YES, I WANT TO CLOSE MY ACCT.

    Besides the fact that the [man] I rented my condo from went into foreclosure and now holding my deposit hostage, and I'm homeless...I am now $175.00 short in my acct and have no money to buy groceries.

    This is regarding the handling of clearing of debits & credits to determine NSF charges, all at the convenience of BofA's discretion leaving the customer with no alternatives other than being at their beckon call. They assess NSF fees on check card purchases that are pending even when it's a disputed charge (in my case the merchant admitted their error). To try and resolve this you are forced to 'wait' until the transaction is posted all the while they charge you the NSF fee when it's in pending mode. You are then tossed back and forth forced to wait the 12 hour response time to just receive an answer that does not apply to your original question. No one person accepts responsibility and their front line who apparently have no knowledge or authority to resolve problems.

    My last complaint is their bank to bank transfers. They debit your money immediately but don't credit it until three full days leaving you wondering where the money is sitting and you have no access to it. My originating bank admits that they process withdrawals first then deposits which resulted in an NSF activity even when my bank paid the transfer but BofA never credited the transaction until 3 days after the fact. They ended up locking my account from transfers pending a letter from my originating bank that my account with them was in good standing. I immedately had my other bank do this and they faxed to them (following BofA's instructions) that same day.

    To follow through on this, it has taken me 5 emails, 3 faxes, 4 phone calls within the last 3 days. Finally hearing from a Rudy (who claims he's a Manager), he offered no form of an apology for the inconvenience rather flatly denies receiving any faxes (i have confirmed fax numbers with their agents with confirmed fax receipts), puts the blame on me and decides to empower his authority by requiring more paperwork and legwork on my end. His requirements were not even closely related to what I was originally instructed to do three days prior.

    Hardships were no access to money that was debited from my account and loss of personal and work time due to trying to resolve these problems and getting the run around.

    My father deposited a check to my new Bank of America account, less than 30 days, on 08/19/08, to help me with educational expenses. The bank did not notify him at the time of deposit that the check would be placed on hold. Contrarily, Bank of America cleared the check on 08/21/08, as the paying bank, Chase released the funds on 08/20/08. Nevertheless, the account was placed on hold 08/20/08 by the bank who claimed the check was fraudulent or counterfeit. I notified Bank of America that the paying bank released the check. However, as of 09/04/2008, Bank of America refused to release the funds that were in my account prior to the deposit of the check in question, and they did not credit my account with these released funds.

    According to page 15 of Bank of Americas Deposit Agreement and Disclosures under special rules for new accounts, the first $5,000 of a days total depositand the excess over $5,000 is available by the ninth business day after the day of the deposit. Is this bank allowed to hold on to my funds for this length of time (over 14 business days) and not credit my account with and return the funds released by the paying bank for this length of time? Furthermore, I was told by Carlos, of the Risk Management Department, that a cashier's check of my funds was sent to the Compliance Department on 09/04/2008, that there is no way for me to contactthis department, and that this check is on hold in this department. I would like someone to give me legal counsel on this matter. Thank you for your prompt attention and response to this matter.

    I did not have the funds to pay my tuition, as I was a full-time student, and I do not have money to pay my rent and bills. This is completely unheard of and ludacrous. This bank is trying to toy with me and give me the 'run-around'. I would like my money back.

    On September 5th I went inside the branch to deposit my check, the teller notified me that they had to place a hold on my check. I was aware the I only had $101.29 dollars available to me and the there was hold placed on $520.00 I went ahead n made two purchases and never overdrew my account. The minute I found out that the hold was removed (which was 4 days later)I went ahead and withdrew $480.00 and the $20.00 I always checked online and over the phone and made sure i wasn't negative in funds (which I wasn't!) As far as knew I STILL had 12.66 after my last transaction.

    The next day I had two overdraft fees. They only removed one of them. I called back to see if I could get the second one removed but they said no. I asked if I was going to get anymore fees and the man I was speaking to (Hugo) said no. I checked in online today and I am now being charged $128 dollars in overdraft fees and I never even overdrew! They were being very rude to the point that I even started crying! I am VERY UPSET! I cant believe that this bank steals money and gets away with it!

    My husband made a cash deposit on 10/19/07. The dep was made after the cut-off time, so I assumed the amt would be posted on Mon (10/22). Based on the fact that I am very efficient and ck my balances frequently, when I ckd it on 10/23, tha balance did not reflect the deposit. I immediately contacted cust serv and spoke to Ruben who explained that where the acct was opened in Massachusetts, that it would take an add'l business day to post, he assured me not to worry.

    A couple wks later I rcvd a ltr to contact the branch mgr, so I did and she said she would have to ck with each teller to see if the transaction was presented. She responded in a couple wks later saying no trans was posted. At this point I am very upset and can now not locate the receipt. I did req that I be able to view the camera surveillance in the bank, she said she will ck on that and call me back, no call back, at this point I have rcvd a ltr on 12/17 stating acct remains overdrawn and I will be going to collection agncy. I am very upset-keeping my credit good is very important to me,

    I called Ms Lopez once again who states I am unable to view the surveillance and nothing she can do, so I wrote a ltr to Dawn (Reg Exec) on 12/18/07, no response from her. I am not in collections, which I did dispute, apparenlty the agent is no longer with the agency, when I called I was informed this, spoke to Gordon(Recovery mgr) who states that my dispute never made it back to Bank Of America, so he added it to the dispute log and sent it off--still no response from Bank of America

    Now on credit report; resulting in damage to my credit score. Now unable to xfer credit card balance or apply for home equity loan.

    I went negative in my account do to a new job and different pay days. I understand that the bank needs to charge fees for NSF, but I had 4 transactions that went through, I had enough money to cover 2 of those until my deposit came in the next day. SO I thought for sure they would cover the small transactions and charge me for the other two. Well they went ahead and charged me a $35 fee for all 4 of them. Which is totally insane when the money was there to cover 2 of them.

    They charge you on every little thing. They told me that the way their policy works when it comes to NSF is that they cover from biggest to smallest. So if you have money in your account and you have enough money to cover the small transaction and not the big one, they will not cover the small one, so you'll get two fees instead of one. INSANE! I can't stand this bank, they are just not willing to work with you at all.

    I have heard of this happening to other people. I pay my bills online. I always check and make sure deposits show. I made a deposit one day and went to pay electric bill that night. Checked to make sure deposit was listed. Paid my bill. Next day I saw where there insufficient funds. The bill got paid that night but they now said the deposit didn't get made till next day. I had 5 smaller bills which weren't affected but they took the money for the large bill away and charged me for ISF for the other five too. The total for ISF was $210.00. One of the small bills was $4.95. This is outrageous.

    Couldn't get much satisfaction from the branch manager. She did give me 20% of it back. I ahve been sick and not working much. Trying to get back on my feet and was getting straightened out but cutting my finances real close. This hit hard. I wish I would have printed out what my account said that night becuase it changed the next day. If I would have known this I could have waited till next day. Also I asked why all six charges were charged ISF. She told me that the large elctric bill cam in first. They all were charged on same day. It shows where all 5 small ones were first on my statement I printed out. If anything I think I should have only been charged one ISF fee as there was money there even without the large one and the deposit I made.

    This is a rip off I feel and maybe you can help me as I am very financially strapped and now will be late on some bills. I feel I should not have to pay at least the $175.00 for the 5 small ones. The economic damage I have suffered was $210.00 and now I can't pay any bills until that is settled. I do not have the extra money. I am trying to get back on my feet and working when I can after an illness.

    Bank of America is arranging or doctoring when debits are presented to the bank to charge it's customers the most fees.

    Because of this arranging, they have charged my checking account hundreds over the last year and most recently over $170. I have emailed customer service to dispute the charges and all I get are run-around and a PR response. I'm sick of it.

    I was enrolled in credit protection plus by BOA. I did not sign up for this, it was done without my permission. I realized this after 3 months. I called to be taken off in mid-July as I was furious. The phone attendant first told me, I signed up and therefore I could not cancel!!After 30-45 minutes of arguing, I was finally told the money would be refunded and I would be removed from the plan. I looked at my statements recently and found that nothing had been refunded. I called again to complain. They stated they could only refund the last statement (which they never did 2 months later).

    I asked for a form with my signature on it showing I had signed up for this service. They told me they were not required to show me this. I then informed them, I would happily pay the cost of the service if they could show me MY SIGNATURE authorizing the plan. The phone attendent responded ...I requested a refund and they would only grant 1 month refund for the cost of the plan. He then informed me, I had my choice of seeing my authorization or the refund. I thought this was beyond ridiculous. I told him I wanted to see the authorization and I wanted the refund.

    The refund was suppose to be applied for 1 month of the plan cost, none of which has been refunded. Also, the letter that came to me just said I authorized this 4/1. Which I absolutely did not. They are unable to show me my signature or any document verifying that I signed up for the plan.

    I used my check card while on vacation recently and continued to check my account and the money was being deducted from my account as the days went on. This went on for about 5 days. When I got home from vacation I realized that my car insurance needed to be paid so I made the decision to use the banks service of allowing overdrafts and paying a fee. I check my account the next day and found that I had over $600 in overdraft fees.

    I call the bank and they told me that all of the charges that I had made posted to my account on the same day that I overdrafted my account making that all subject to overdraft fees. Even thought most of these charges were made 4 days earlier when I was sure I had money in my account and they even removed money from my account at that time.

    How is a person supposed to know when a charge is posted when we as customers don't have access to that information? I saw the money come out of my account so I could only assume that my account had been charged.

    My account was charged over $600 in fees and I am now going to have trouble paying my mortgage payment. I am so worried about this that I am having trouble sleeping and eating.

    Wachovia will not accept the Durabale POA form which has been approved by the State of Florida so that I can access funds from my Uncle's account to provide his Medical Care now that he has suffered a Stroke.

    If the matter is not resolved by this Friday;I will have to dismiss my Uncles care giver do to inability to access funds.

    i had a checking account with bank of america and got in to payday loan debt and they closed the account but they reported me to chexsystems as suspected fraud activity and i did not commit any fraud and this is a nightmare that wont go away and they are very rude and unprofessional and i have tried several different avenues and they dont work

    i need some help. this has been 2 1/2 years ago and going 4 more years without an account is ludacris. no checking account

    I have recently opened an account at Bank of America. When I opened this account I was NOT told that any checks that I deposited were going to be put on hold for a considerable amount of time. I deposited a check, and looked at the reciept before pulling my car away to make sure they had the date it was and the amount, which it did.

    Well I logged onto my account the following Thursday (a full week later) and notice a negative account balance. I call the customer service center and speak with a woman named Rhonda. I explain that I logged online to my account notice the negative balance, but a positive balance on the side. I told her that I looked at my deposit again and then noticed that they were applying a hold on these funds until one week and one day 5pm after I deposited this check. I also told her that I checked the bank that the check was from and it had cleared that Bank 2 days prior then me speaking to her. I told her that now I'm going to be having all of these overdraft fees, and is there anything I can do. She placed me on hold, and came back with that the Bank would as a courtesy to me, they will be refunding these fees, because the bank knows you need YOUR money. I paused and said Okay and was in shock that it was that easy. I Thanked her again and again because I was so upset that this had happened.

    Come to today, and I speak to Monday, a supervisor. I explain to her what I had told the previous representative, and that I had admitted that I did not see the hold date on my reciept and Rhonda told me that not to worry all fees would be refunded. She said because the piece of paper they gave me stated the held date, it was there policy that they cannot refund my money to me. I was IRRATE! I asked her how that could be when Rhonda had just told me 3 days prior that the fees would be refunded. Well I was told by Monday that Rhonda was incorrect for telling me that, but I was going to have to pay the fees anyway. I asked if this was a practice to tell customers that fees will be reimbursed and than say oh opps she was wrong and not give them there money back. She then decided that she would try and tell me that I write checks fraduently (which I don't), try to refocus that the Banks representative was in the wrong.

    I have to pay $220 worth of fees, and my savings account is emptied out.

    I am charged hundreds of dollars every month by Bank of America! I have acually been charged a 35.00 NSF charge for being short 2 PENNIES! This is crazy and something needs to be done about this bank stealing our money. I have 4 small children and they {Bank of America}, take food out of their mouth every month.

    I've had problems with BOA every since I first opened my account. I have since closed my account. In one situation a BOA customer service rep told me that she could block a company from taking money out of my account. I ended up paying $35.00 for the service and it didn't work. They allowed the company to take the money out and I was out of $155.00.

    Back in late May or early June I asked BOA to close my account due to all of the overdrafts and mistakes that were being made. On July 31, 2008 a income tax rebate was deposited into my account that I asked to be closed. BOA took the check as a charge against what they called an overdraft. How can an overdraft occur when I asked them to close my account over two months ago? How can they take a check that belongs to me when the account is supposed to be closed? How come this bank is allowed to continue abusing customers and who protecting them?

    According to my calulations BOA owes me over $400.00. I am trying to get legal advice on how I could file a lawsuit against BOA. Those two problems are just two of the problems that I've had with this terrible bank.

    I was at branch on 23rd Cicero. I went threw the drive thru to make a deposit. Place the deposit into the canster and i asked for the check to be cash and could i please get a balance on my account. The drive thru teller (javier) asked me for my I.D. i asked why know one has ever asked me for it be before. The Teller Stated if you want to know your balance i need to see some I.D. I said no just make the deposit and let me speak to your manager.

    the teller told me to come in because it was another car behind me. i was so upset i park my car in the handicap space. came into the bank and asked to speak to the manager. When the manager explain the policy it came to my understanding that none of the bank teller are doing there JOB. I came into the bank to get the bank but instead the teller gave me a deposit slip. I tried to go back in to inform the that this is not what i wanted i wanted the balance they refused to let me back into the bank where my money is the guard threaten to call the police on me if i didn't leave the bank, but the took my deposit but i couldn't get good service.

    the bank manager did say that she would have to talk to her teller to see what procedure are they using that for my protection they asked for I.D. I was trying to explained Know one has never asked me for my I.D. and why am i being treated like this. Today is 09/06/2008 and my deposit is still not in my account.     On 09/04/08, I received a Bank of America check for services in the amount of $4745.00. I responded to the issuing branch to cash it. I presented the check with a valid photo ID and was told they would not cash a check in that amount because I was not a B of A Member. I was then asked if I wanted to open an account. When I declined, I was again told they would not cash it. I confirmed the check was valid, was issued by their branch, the funds were available and my ID was valid. I was told everything was in order but they would not cash a check in that amount because I was not a member.

    When I asked what amount they would cash, I was told that information was confidential. When I asked for a written policy I was told there was nothing they could do and to take the check to another financial institution.

    At considerable cost and inconvenience, I took the check to another financial institution which cashed it without incident.

    Bank of America (BOA) offered Free for Life business checking accounts in 2004, for anyone opening a new buiness acct along with a debit card and personal account. For the past 3 years, every year all 3 accts get charged with $11 monthly service fees & I have to go thru the ordeal of calling or emailing the bank to have these fees credited. Every year, it gets more & more time consuming & difficult to get these fees credited - since they no longer offer a free for life business account. And then they tell me that they can only waive the charges for 1 year.

    I unwilling let my account to go $10.00 negative because of my pay schedule changing. I noticed the change immediately and deposited $80.00 in the account to fix the problem. I went to the bank on Saturday Aug 30th the next day and spoke with someone there. They told me not to worry the charges are still PENDING (Definition: remaining undecided; awaiting decision or settlement; unfinished)and you have deposited the cash before it CLEARED.

    Now I go on my short getaway. I used my card 3 more times knowing that I had money in the account. Now Tuesday Sept 2nd (over a long weekend) comes. The first 2 overdrafts they said not to worry about...well they charged me $25.00 for each instance (I also had overdraft protection on my AOPA card). I visited them again asking why this is. After a Ballet of BS which was just a ruse to cover their fraudulent fee practice.

    Since they charged me $50.00 in fees I now had a negative balance( before they told me this could not happen because they where pending). Now I have 3 more fee charges to the sum of $35.00 each. Why the change? from $25.00 to $35.00. When I was speaking with someone there they informed me I had no overdraft protection! I HAD TO set it up when I canceled my other Visa card that initially had it and they transferred it to the new card.

    I now cannot afford to pay my mortgage on time due to their ineptitude and fraudulent fee practices. This is theft, stealing.

    I made two debit transactions on one day, that night I check online my available balance. I seen my available balance was down to 60.00 odd dollars which already included my debits that and I knew I had possibly an automatic withdraw for my some prepaid college coming out possibly that night. So I transferred money from a savings account to the checking to cover this upcoming automatic withdraw and it showed my available balance for that day would cover.

    I check my account that Saturday morning and noticed not only did they post my transfer with Thursdays date, but the two prepaid college transactions posted prior therefore having overdraft fees. Then those two debits posted afterwards incurring more two more overdraft fees. I called and spent much time, finally got back $21.00 bucks out of $140.00. Personally

    My second story is simple, they received a reaffirmation agreement on a loan and claim they did not receive it on time and that it was sent back to the attorney because something was missing and they did not get it back on time. Now for the life of my loan it will continue to report as in bankruptcy to the credit agencies. Yes I would love to sue them since they have no regard for hard working people who have to work long and hard for our money. Next on my list is filling a complaint with OCC.

    $119.00 in overdraft fees and a credit report that shows my home loan as in bankruptcy until the loan is paid in full priceless.

    I was vacationing and was using my debit card-I always use it as a credit card. Anyway out of the blue appears 10 overdraft charges all at once. I had two items that I knew would go over, but not 10. My online balance and statement never showed more than the two items overdrafting yet Wachovia people on the phone put me through this like 40-minute speal about how basically their website lies to you. She actually admitted it!

    Cost me $350. Does anyone know of a class-action suit going because I know there have to be more victims of this highway robbery!

    I have been a customer of Wachovia (Southtrust originally) for over 8 years. In these 8 years I have been what SHOULD be considered a great customer. I have paid $9 per month for this checking account of mine and only recently have I realized that almost everyone, including Wachovia, offers free checking under certain terms.

    I overdrafted my account due to a stupid mistake on my part and ended up with $254 in NSF fees because of several small debits I made after the initial overdraft. Although Wachovia agreed to refund half of these fees as a courtesy, this is completely unacceptable in my opinion. I just feel Wachovia should overlook these fees ONCE considering my track record. In my estimate I have paid Wachovia close to $900 for the privilege of having this account for the past 8 years and then they treat me this way?

    I took this to the highest power I could over the phone and ended up with the usual there is nothing we can do. Needless to say Wachovia lost a great customer. However, now I realize I never was a great customer to begin with because they obviously rely on these fees to keep their business up. In summary, I messed up ONCE, they took advantage of it and subsequently lost a customer. Bad business. Enjoy my $127 Wachovia.

    I use B of A's Privacy Assist Service, which gives me information on my credit activity, for $9.99 per month. I have recieved a letter from Bank of America informing me that I will automatically be upgraded to their new Premier Service at month-end, and the charge will increase to $12.99 per month. If the consumer does not want the service, he is given an 888 phone number to call to decline.

    I have had to call twice, the first time getting cut off without speaking to anyone after five minutes on hold, the second time on hold for over 35 minutes and counting (I am on hold right now as I wait for an answer). I plan to cancel this service, if only Bank of America will answer my call.

    I have only had an account for 3 months, but it has been the most unpleasant experience. I assumed my money would be safe with Wachovia. It turns out, it's safe from outsiders, but not Wachovia itself. In the 3 months, I have paid over $300 in overdraft fees. I always watch what I spend, but the way they process charges is a scam. After my first overdraft (7 charges). They explained it. By the way, it's impossible to argue out of an overdraft with Wachovia. Even though the charges in question weren't posted, or even paid for by wachovia yet, they charged the overdraft fees.

    The manager at the Kissimmee branch explained that the charges were not posted, or paid for by wachovia, so I ask why I am being charged? They have no real answer. I argued that my account wasn't negative until they charged me the $175 overdraft fee. Really, I never got an excuse from him why, but they must go through alot of training to give their customers the run around. Though my account was NEVER negative, they charged me nearly $200 2 times, then putting my account in the negatives.

    This whole mess with Wachovia has put me back, here I am, unable to drive or pay my bills because Wachovia stole the last check I was to receive from my last employer. I am now looking for a new bank.

    We deposited $5232 at Wachovia's Van Ness branch on 08/20/08, at 12:22PM. Wachovia decided to put a hold on the total deposit amount for seven full business days, the deposit was only available on 08/29/08. The check is from a multi-state, multi-hospital health care hospital held at Baltimore branch of Bank of America. The availability schedule (229.12) of the Code of Federal Regulations specify that a deposit of an out-of-state check can only be held for up to five business days.

    During the 2 additional days the deposit was unavailable, we had one automated debit for an utility bill(PEPC0) that caused the account to be overdrawn. Wachovia charged us 3 x $35 Nsf fees. When we called, their customer service explained that PEPCO presented the bill payment request three times, hence, the 3 NSF fees. Wachovia's online statement though only shows one PEPCO payment, on 08/28/08.

    I called PEPCO to find out why they presented the bill to wachovia three times without my approval. They confirmed that the payment request has never been declined by Wachovia and that their procedure is to present a bill payment request one time, if it gets returned unpaid, they would call the customer and charge a $5 return payment fee. $105 (3x$35 NSF Fees)

    Just incurred over $140 in overdraft fees because BofA rearranged my purchases, payments and deposits to their liking so they could charge me 4 overdraft fees. Customer service tried to explain and did not make sense and just back peddled. I bank online, so basically keep any record by online banking is pointless. They have done this to me time and time again and I am tired of it!

    Over $140 in overdraft fees-now have a negative $140 balance in checking account when it should be at $0.

    For many years I've used BofA for both business and personal banking. For many years I have fought with them over fees and unexplained charges, overcharges, and lost deposits. I have had many fees reversed.

    I've spent over $10,000 in fees - much of that was reversed due to bank errors, but much of it was paid by me. Along with merchant fees. Yesterday, I was charged three NSF fees when PENDING charges hit my account. The reps can't tell me why all three were charged fees - because two totaled far less than the balance of my account. One was for more. I'm not sure how they got three fees, but get this - today I got charged another NSF fee when the actual charge hit (yeah, the one that was pending before is now a real charge and since the three NSFs from the day before overdrew the account, this incurred two more nsfs.

    How can they charge me twice for the same debit ? (They told me the original 'auth' was the 'charge' and that I had committed funds to that once I made the purchase, but how then can they ding me again when the charge actually 'hits' the account? This is a very expensive snowball affect. PLEASE - LET'S CLASS ACTION

    I have had an ongoing problem w/BOA for the last 4 months or so. They have taken over $500 of my hard earned money, and now are stiffing me on a charge that wasn't even mine. They have a habit of taking one or two overdrawn items, even as small as a dollar or two each, and ending up with 5, 6, 7, or more overdraft charges by adding the OD charges in as far back down the line of paid charges as they can.

    Example: two weeks ago I forgot about a 15 dollar gas purchase, and ended up going overdrawn on three other charges. I noticed while doing my online banking and went to the ATM, adding enough to cover all but one payment of $14. I was expecting a fifty dollar negative balance from this. However, they went down into the Cleared part of their listing...things that are supposed to have already been paid, and according to the businesses, had been.....and began adding charges. By the time it was all over, I was around $250 overdrawn!

    I called and yelled at them for stealing my money, and the manager kindly cut half the charges, leaving a $130 deficit - better than nothing. What really got to me was her telling me that yes, the online site says Cleared, but THAT ISN'T NECESSARILY TRUE!

    Before that, a charge from Sirius Radio came through (I don't have and never have had that service) and caused $210 overdrawn charges. I disputed it, had the charges reversed, and then sent in a form they sent me to sign. A couple weeks later I got a notice saying they never received it, so I filled out the replacement they sent and mailed it the next day. Checked my balance on the day my check was autodeposited, and found the charges had been reinstated. Tried to call, got no one. Sent a message through their website. Tried several more times to call, finally went through the regular number and had myself connected manually by them. The guy I spoke with checked it out, saw that the deadline on the second form was 8/19/08, and it had come in and been scanned into the system on 8/18/08. Thinking all was cleared, I breathed a sigh of relief.

    Next day got an answer back from my online query telling me there was a deadline, it may not have been met, and even if I reopened it, THE CHARGES WOULD REMAIN ON MY ACCOUNT EVEN IF I WERE PROVEN TO BE RIGHT! How can they do this? They are outright stealing from me, have been for several months, and I can't do a thing about it. I know when something is overdrawn I will get the $35 charge for it, but how can they then add that charge in several paid transactions earlier than it occurred, driving more payments overdrawn, adding more charges, driving more payments overdrawn?

    I am disabled, trying to live on a fixed income, and working toward becoming self-sustaining with my new job. However, these people are driving me further into debt by causing me to be unable to pay the bills I have to pay to survive and keep working because I keep having 2 to 3 hundred dollar debits before my next check comes in. It simply isn't fair, and something should be done.

    On June 18, 2008, Wachovia Bank withdrew $24,038.18 from my checking account on a check from another bank. The check was an Exchange Bank check written and signed by the person whose name appeared at the top of the check. Nowhere did my name or Wachovia account number appear on the check.

    To cover the check my overdraft protection of $1500 was transferred to my checking account. In addition $7,849.00 was transferred from my money market account to my checking account. All of this was done without my knowledge or approval. I only learned about this when I received a statement for payment to my overdraft protection account PLUS INTEREST.

    All of this took place without a single contact from anyone at Wachovia Bank as to how I would prefer to handle such an overdraft. Is it Wachovia Banks policy to honor checks written on accounts other than the account holders name and account number? Actions such as this should be inexcusable from any banking institution.

    Bank of America scams people out of their money with their Outrageous overdraft fees. I checked my account at 3am (I have a new baby and am up all hours of the night) and my automatic deposit was pending for today's date. No other pending transactions, just the deposit. At 9am, two checks were overdrawn that had today's date. Now, at 3am, they were NOT pending, nothing, but at 9am they have went through, bounced, and claimed to have went through on yesterday's date.

    How could this be? The one check was for $5.00 and one for $150, and I had over $100 in the account, and of course, they put the $150 through first, so they could charge me two overdraft fees. Something else that I have noticed.. Checks, debit transactions, credit transactions and deposits will pend for a day, sometimes two to three days, but when you don't have enough in the account, the bounced transactions NEVER pend. They go through IMMEDIATELY.

    If I didn't have my mortgage, equity loan and all of my checks automatically deposited into this bank, I would change banks. But, I feel like I'm stuck. They have probably taken over a thousand dollars from our family in the last several years just from overdraft fees.

    A check I payed a bill with went through a day earlier than i expected and it took my account over a couple of dollars. Wachovia decided that in helping to protect the big bills that may be most important to me that they cleared the check first and then charged me 10 $35 overdraft fees for small debit transactions made prior to them recieving the check instead of charging me one overdraft fee of $35. If they were going to honor all of the other small debit card transactions anyway, why pay the big check first when it was the last thing to go to my account.

    It would seem that Wachovia is making sure they get as much money from you as they can under a false pretense of protecting you. Because my account was over drawn $2 i have had to pay almost $400 dollars in overdraft fees. I dont know how I am going to get to work this week or how i am going to eat. Wachovia [made] a bad situation even worse for their own profit. The government needs to do something about Wachovias loan shark actions.

    I am writing this letter in hope of a resolution and because of the outrageously disrespectful manner in which we have been treated on more than one occasion. My husband and I have been having financial problems now for several months. We owned our own business which unfortunately failed, and mine was the only income we had to live off of for several months. Being in the small town of Seaside, Oregon, there were not many job opportunities for my husband and so we decided to move to Las Vegas. I am happy to say that within 2 weeks of moving, my husband and I are both gainfully employed.

    Before we moved however, I had set up an automatic payment with a lady named Melissa. She was very nice to me on the phone at that time, but unfortunately that was not to last. There were some unexpected problems with our bank account and the payment did not clear. When I found out this happened, I gathered together the only money we had ($700) and went to my mother's house, gave it to her, and we called Wachovia and made the payment with her account instead.

    About a week later, I received a phone call from a woman named Tracy on my voice mail. I promptly returned her call, what I was met with was less than polite behavior. She informed me that the last payment I made had bounced. I told her that I didn't understand why because it was my mother's account and she had over $10000 in that account but that I would call my mother to find out what happened and call her back. I called and spoke with my mother immediately who checked her bank account online and said that the payment had posted to her account on 7/30. I called Tracy right back and let her know this, and she continued to argue with me for over 15 minutes about how I was wrong, that the bank was wrong, that we needed to call the bank, etc.

    Finally, she decided to check some other information, came back on the phone, informed me that it was the previous payment that had bounced, was rude about it, never apologized for the incorrect information, and continued her extreme rudeness. She asked me when I was going to make my next payment and I told her at that time I wasn't prepared to give her an exact date because I didn't know what our finances were going to be like but that I would make every effort to make a payment as soon as possible, and I meant that.

    However, Tracy informed me that that was not good enough and continued to lecture me. I was finally so upset that I hung up the phone. I couldn't believe how I had been treated. She then proceeded to call me THREE TIMES in a row within less than 5 minutes. That's just about what I would call harassment. At that point I had no interest in speaking with anyone because I was trying to do what I could to get the situation resolved and was being treated like an unruly child.

    I would also like to say that I gave Tracy my new phone number when I called, and that I had given it to the previous person I spoke to when I made my payment as well. We also informed Wachovia that we were moving to Las Vegas but did not have a permanent address yet. We are certainly not trying to hide, but I also don't expect to be harassed EVERY DAY. I receive a voice mail from Melissa every business day, sometimes more than once a day, and it's got to stop! Why would I want to call a place that is only going to degrade me and treat me like dirt when I'm trying to do the best that I can?

    Today, Melissa left another voice mail. My husband wanted to speak with her since he knew I was still upset by the way I had been treated. He called Melissa and spoke with her briefly, and this is why: He called Melissa to make payment arrangements, letting her know that we were both now employed and would be receiving our first paychecks within two weeks and would like to make a payment at that time, and every two weeks thereafter until we caught up which wouldn't take long. What he was met with was a rude rebuff, Melissa informed him that Wachovia "just didn't want to deal with us anymore-- and that our arrangements were unacceptable, that we were going to be taken off the registration, and that she was going to call the sheriff's department and have us arrested for theft. HOW RIDICULOUS IS THIS?

    I have an extensive background in customer service and collections, and I understand how hard it can be to get people to make their payments. But in my years of experience, I have never treated anyone that way nor would I expect someone else to treat me that way, especially more than one person from the same company. I am considering reporting your company to the better business bureau unless there is some resolution. I can't think that we are the only customers who have been treated this way by Wachovia, especially after the things I've just read online.

    This Bank [takes] enormas overdraft fees by moving charges around so they can overdraw your account, overdrawing your accounts for pended charges and then you find the charges reversed to positive the next day, charging $35.00 for overdrafts for charges amounting to $8.48, choosing to assess charges that will net them for example 5 or 6 $35.00 overdraft fees when they should be no more than one.

    However, their customer service department claims they pay the largest ones first as a service to the customer. How is that a service when all are paid by the bank, large or small? It is a method they are using to excessively charge your account. One day a charge is posted, the next day it isn't.

    I've made a cash deposit when a charge is pending. They claim they instituted a new policy that does not count the cash deposit immediately, thus when the posted the pended charges, they did not account for the deposit until have the pended charges posted and took all my money in overdraft fees.

    Well I have been with Wachovia for the past 5 years of living in Fl because they offered good services and i thought it would be a good bank. When I got married I added my husband to my account as co-owner and got him to open a Wachovia Business account because I had so much faith in this bank. We were fairly careful witrh our banking and when overdrafts were maid we paid them in a timely manner and didnt dispute them.

    However about 2 months ago our account was over drawn and the bank started to call my husband and send him letters. My husband didnt bother to let me know about the status of the account and him being the one in charge i never thought anything was wrong. Since all the letters were addressed to HIM ONLY even though its a joint account with me as PRIMARY i never opened the letters because i assumed it was for his business account.

    On 8/15/08 I noticed an open letter read it and realized that the account was over drawn. I immidiatly went to the branch and attempted to resolve this matter and was told to call the number on the letter, when i called the number on the letter i was told i had to make a payment of 135.66 and that it had to be with a debit/credit/check. I attempted to take care of it with a check/debit card but could not because it was from the same instatution and when i asked if i could make a cash payment at the branch they told me it would be $192.66. They said to get a friend to use their debit card from a different bank to take care of this problem monday morning.

    Monday I went to my job and spoke to a friend made a diposit after work into her account and was on my way home when i got a call that our area was on madatory eveacuation so i spent my day at a school gym with no access to anything. I called wednesday 8/20/08 with the check in hand and was told that now that my account was 58 days past due i HAD to pay with debit or credit card. I spent a whole week trying to take care of an over draft and got nothing but the run around and threats that account will be closed and reported to all other banks and that i would not get an account with any other bank.

    I dontr understand what kind of bank service wont allow you to make transfer between accounts, that only contacts the secondary co-owner and then proceeds to refuse all methods of payment. it seems they want to charge the extra $40 it would be if account was forced to close. I am at loss of words and cannot believe that I was treated so poorly by the place where put my trust and funds.

    I am out of over $200 and will be [blackballed] at every other banking instatution, I was hasseled, ignored, and basically looked down on as an incompatent idiot. Customer service told me over and over that there was nothing they can do as well as the overdraft RESOLUTION center where i was told the same thing. I was Lied to and confused and cheated. Never did I get a phone call on my phone or a letter in my name. I am so disgusted in this bank!

    I went online and checked my account on 8-18-08 and everything was fine. Over night Bellsouth automatcally debited the account on 8-19 one day early. This threw the account into the negative. I put the money in the account right away to bring the account out of the red. I checked the account again on 8-20 and I had been charge two $35 over draft fees. The bank said that the items cleared on the 8-18 and by 8-19 it was too late to put the money in to avoid the fees. I asked them to check the system so they could see that I log in daily and the account was not overdrawn on 8-18.

    You can't argue with someone when you no longer have access to the proof and they can do and say what ever. But my mother is a witness. Our accounts are linked, when she goes on to view her accounts she can also see mine. She know that on 8-18 the account was fine. She is the one that notified me the morning of 8-19 that the account overdrawn and she put the money in. I was on the phone for over an hour getting nothng but fast talk. In the end I became frustrated and hung up. I was charged $70 in overdraft fees.

    Right now I haven't done a lot of research on this but I have to say at least something here about Wachovia bank now to get me by until I get more information to paint the picture of this crap. I've been using them on and off for about 5 years and the last 2 years I've used them constantly. Generally speaking I've found that Wachovia seems to take too much power out of me(the customers hand), I heard another person on another form refer to them as WALK-ALL-OVER-YA, this really is very appropriate. When you get screwed by them and left helpless on the other end of the phone line, their customer service rep might fight you back by saying Wachovia's has this great reputation and got some good online banking award or something and your must be wrong this would never happen at Wachovia. I could see Wachovia getting the waste the most time and energy plaque, or the #1 confuse you the most award or the We made the most customers do a pretzel bend or produce near forensic evidence to get an nsf charge refunded when I wasn't even their fault, or the record wait time at the drive through teller award, or the most irritable tellers and most unhelpful tellers award and much much more these awards.

    And I like this one..some people are policy worshipers who can't differentiate between when the demanding complication of policies makes it to demanding and impractical to even use a bank in the first place and many people don't even have the time or qualification to fight it; They say the same ol thing Well you checked that little checkbox of the terms and conditions before opening the account. OH YOU MEAN THAT checkbox with several pages of fine print that IS SUBJECT TO CONSTANT CHANGE WITHOUT NOTICE that some gifted lawyer wrote that basically takes power out of your hands and is obviously pro Wachovia when opening that Wachovia account? I KNOW TOTALLY MY FAULT,

    I almost wanna say most people probably get a checking account with a debit card as almost mandatory now days. Who knows for sure but I know I'd have a hard time boycotting banking or do pretzel bends for these people to fit in with there evil, subtle, damaging and blood sucking policies, I could also open my mouth and let someone **** in it, it would be about the same thing as Wachovia charging me $200 NSF fees in a matter of three days for one overdraft like they did 3 three days ago. Before as I said I haven't had my precious time to waste yet and still don't which it will take to dissect this and learn the constantly updated "Wachovia 101" yet; So these damagers probably have a way of legally doing this crap but again common sense and balance tells us something is wrong. If this were honest they'd be charging us 1-2$ per bounce instead of 20- $70 each! How about $1 or $2 for a bounced check that wasn't even my fault as opposed to $200 in three days because again one charge that I didn't even authorize. Hear that folks $200 in only three days over one bounced check. It would be extremely bad for me if they only charged $1 for each bounced check but at the rate their charging hell I'll be 10 million in Wachovia debt in few years if I keep banking with them. Plus of course everyone gets the usual run around of several different departments to inquire about their ownself getting screwed.

    I don't need to have world war three just to bank with someone and that's what I get time and time again with Wachovia bank. Wachovia has developed in me a scary feeling in general. I'm sure many others are tired of defending their ownself to Wachovia when they're the one screwing you. Nothing could be more wrong. I'm tired of getting robed by them of my cash, time and energy. JUST ADMIT IT WACHOVIA, YOU'RE STEALING PEOPLE'S MONEY BY WAY OF POLICY EXERCISES AND SERVICE CHARGES, I COULD ALMOST SPOT THIS BEING 6 YEAR OLD.     since I have been with wachovia I have been ripped off over 100 dollars, what they do is they charge you a 35.00 fee called overdraft unavailable fee and than the next day they will charge nsf fee so 70.00 for one check that bounces. This is de to them letting the Comfort Inn keep on charging my credit card that caused my acct to be overdrawn by less than dollar and they charged me a 35.00 unavailable fee and tmw will charge 35.00 nsf fee this is not the first time they have double dinged me. They are not willing to work with their customers. Since the time I have been with them I have paid at least 1000 dollars in outrageous fees.

    The economic damage is that I am going further in debt as everytime I turn around I am being charged a fee and they always have excuse for it. because of the I will have no money on my birthday and the stress that it causes it unbelivable and the it causes my stomach to be upset and throw up. I have read several complaints about Wamu and nothing done nor is Wamu willing to do anything to help their customers have been on hold for over 30 mins Wamu just does not care I have other issues with Wamu too concerning fees

    The bank charges a future 35.00 debit hold to the account on two transactions (70.00), which nets the account negative due to the deduction of the charge before the debit. Customer no service states that the online banking is just a tool, if the transactions show pending it is not accurate. When I use their tool they provide to me I expect it to be accurate and up to date.

    Overdrawn on account, which would not have happened had their fee(s) not be deducted before the charge was not pendng to the account.

    I had a payroll check, drawn from a Wachovia account. Wachovia will not honor the check, unless I pay them $5.00, or open an account. It seems like a small price to pay to cash the check, but it is the principle of having to pay someone to honor thier own financial instrument.

    When opening my checking accounts, I had a check card / ATM card ordered, linking my checking accounts for transactions to include: Point of Sale Merchant puchases, online purchases, ATM withdrawals, etc. There is an option that the bank offers that you may have your card shut off when reaching a zero balance. I WAS NOT MADE AWARE OF THIS upon opening my account.

    My deposit agreement does not state anything as such in its Agreement. My account went to zero and I was unaware and went about making purchases, not knowing that the Bank was paying the point of sale purchases and on top of that, charging me $35.00 per point of sale purchase. How are banks able to legally get away with stealing your money, and they NEVER made you aware in the first place that you could have your card shut down when you reach zero? Please advise.

    In debt approximately $1,000.00 to the bank. I had a direct deposit go into one of the accounts on Tues., August 12, 2008 and all the bank fees were automatically deducted away from me.

    Bank of America has been my bank for over 15 years. I withdrew money from my account. They gave me a counterfeit $100.00 bill. I didn't know it was counterfeit until after I spent it. The restaurant where I spent it deposited it back into the same BOA branch where I withdrew it. They told the owner that they couldn't accept it because it was counterfeit and confiscated it. The owner came back to me. I went to the bank with the owner and they refused to make it right saying that they had no proof that they had given it to me. They definitely did - I have not gotten any other $100 bills from anywhere else and don't use them very often so I would know if I got one anywhere else.

    BOA would not agree even to split the loss with us. I covered half as a good faith gesture of relationship with the restaurant owner who accepted it from me. I am removing my money from BOA and will not do business with them again since they didn't find our relationship of 15 years worth keeping. I recommend that you do not trust them either since they are so low integrity and unwilling to take responsibility for their own mistakes. And because the don't care about their customers even when they have 15 years of experience and positive relationship with them. $ 50 loss to me. $ 50 loss to the restaurant owner. Permanent loss of business for Bank of America.

    Three weeks ago my self and husband decided to do direct deposit jointly in the same account at bank of america.Since doing so I have been charged over draft fees every pay period. For instance I made three small purchases under 8.00 each on a Saturday with my account in good standing, on wed.

    morning I found out that my account was in over draft of 13.00, so I immediately went to the bank and deposited 20.00 to cover these charges and was in the positive 0f 6.00. On thursday guess what? I was being charged 3 nsf fees for 35.00 each just because they say these charges accured on monday and they were not posted until 2 days later. go figure.     Apparently BOA has a policy of deducting debits of the same day in order of largest to smallest amount and not in the chronological order it occurred. Meaning if you have a $105.00 available balance and you make 10 $1.00 purchases in the morning and later in the afternoon you make another purchase for $100.00 you will be charged 5 overdraft fees (They deduct the $100.00 first and then ten times $1.00)! That would result in $165.00 for an actual $5.00 overdraft of one transaction.

    I have been told by customer service that this is BOA policy and there is nothing they can or will do about that.

    In my actual case it resulted in $140.00 overdraft charges due to this policy!

    I have 6 transactions posting on my account without my consent. I admit they were my fault because I signed for loans this month- since I didn't get my check yet. When you sign for loans, they pass your info on to third parties, but I didn't see in the fine print that they can charge your account without you signing anything. I am 27 and very smart.. I know that you have to agree with THAT person with paper work or verbally to allow money from your bank account.

    I spoke to Bank of America over 2 hours, which consisted of being transferred 9 times to customer service, to fraud, to claims, to customer service, to fraud, so on and so forth. Usually Bank of America helps me out. I would talk to claims, and they send paper work, I sign and send it back, or customer service are smart enough to see a fruad and they credit it back. Well, not this time. I asked to speak to the supervisors, and they're not clear as to why they can't help me. The last supervisor I spoke to, Dan from Claims department, said well when you sign for payday loans you're agreeing to allow third parties to debit your account for their services.

    I have had to use payday loan companies for valid reasons, and I've never had that happen to me until now. He sounded careless and not eager to help me. He said that there was no way they can help because I gave my consent through a contract- which he hasn't seen, nor does he know which payday loan companies I have dealt with. So now I am stuck with my money being taken away- no phone number for these companies provided. I want my money back and somebody needs to help me.

    I have over six 35 dollar returned item/overdraft fees posted to my account because of these unauthorized transactions. I am negative 91 dollars and will be more by tomorrow, the 14th of August 2008 because of another transaction coming through, that I did not authorize. I am not rich, but I am not a fraud. I don't want to be penalized for someting that is not my fault.

    A year ago my wife applied for a loan on my behalf. When talking to BOA representative on the phone she was (verbally)assured that the interest rate will be 7.99% FOR THE LIFE OF THE LOAN! I made payments since day one and out of the blue, the last statement which I got a week ago, showed an interest rate of 15.99%! When I called them to find out what had happened they claimed that the 7.99% rate was a promotional for ONE YEAR.

    This is my second bad experience w/ bank of america. I deposited $300 via ATM. However, I am not sure if I miss keyed and entered just $200 or the ATM made a mistake but my balance only shows $200. I contacted customer service and explained the situation. The associate told me that if there is an outbalance in the ATM, you will get your $100 the next business day. So i thought everything was solved out. The next week I checked in there was no change. I filed a claim and after theire INTIMATE RESEARCH, they found nothing at all!!

    Now I am filing another claim and reopening the case. How ridiculous is this that we have to fight for our own money?? How can I be so sure that my money is not going to disappear out of my own bank account? This is such a big waste of my time. I have to keep calling them and waste my minutes. And neither is there an instant reply. Their automated service take FOREVER and does not enter things correctly!! I mean are there people working on this or what?

    This morning i just had another incident with Wachovia bank. Last night i came from work tired and look at my account online and it showed that i had enough money on there but this morning on the way to work i stopped by one branch and deposited another check and it told me that i was charged insuficient fee 5 times due to charges that were posted 4 to 5 days ago did not clear till that morning.

    I have called and complained and they have transfered me to their escalation department where they agreed to reverse two of those charges if i go back to the branch where i originally deposited that check and talk to manager on staff and deposit additional money. I have done what i was told to find out after that they are not doing anything towards that manner.

    I called back and talked to management department and all they are telling me is that if i dont know how did i talk to they cant do anything. It took me 3 hours on the phone over and over explaining my self to them and they still would not do anything for me. So they are telling you that they are number one in customer service they are lying. I have not acoplished anything so i just paid them $200 for their mestake.

    Bad company to deal with their customer service is by far not customer service and their management staff is really not helpfull. Month ago i had another issue where i have canceled check online and they never canceled it and it ended up charging me and overdraving my account and charging insuficient fees wich they would not refund. So 2nd bad experience. Both times i have paid over $200 in insuficient fees worth due to their system.

    On June 24th of the present year I went to this branch and asked for a stop payment of a check I had issue the day before for $2000.00. The teller that took care of me was an associate with the ID of NJA2761. Mistakingly this teller entered on the system the wrong check number after she had physically seen my copy of the check. I chose to show her the check so that I wouldn't make the mistake of telling her the wrong number. I asked her how many days it would take for the request to take effect and she replied 24 hours.

    I was charged 30 dollars for this transaction and then I was asked to sign the respective paper work. Unluckily I didn't notice that the teller had entered the wrong check number. Moreover, in the past when I issued checks while not having the sufficient amount of money in my account, the bank refused to pay fro the checks even if I was a dollar short. There I though of purposely withdrawing $500 so that the account didn't have the sufficient funds to prevent the check from getting paid.

    As a consequence because of the teller's mistake of entering the wrong check number, the check didn't get stopped and I lost $2,000.00. I went to complain couple of days after the check got paid and the assitant manager with the name of Ibrahim M. said there was nothing to be done in order to fix the situation. I attempted to work things out again and spoke to Ibrahim one last time on August 12 and he cought a nasty and unprofessional attitude against my daughter who was with me. He told my daughter that I come to the place very week with a different story and he refuse to find a solution. It bathered me that he said that because I only visited the place 2 or 3 times in total and not every week like he said. When we asked to speak with the manager, he said he was the manager and so we told him that we knew he was only the assistant manager so he replied "Well she is not here right now and there is nothing to be done."

    Is this the tip of the iceberg? I received an email from a defrauding company (according to internet research and ripoff report) stating their intention to charge me a recurring charge. I was frightened, because they had my NAME and correct email address! I do NOT respond to unsolicited email. I do NOT click on any links. I delete all spam. I have never done business with them, nor had I authorized any charges to them, but I do do business on the internet. I am pretty savvy and do my best to avoid any internet fraud.

    I called Wachovia Bank to block charges from this company. In the past, Wachovia's Fraud Department has demonstrated pretensions of being active, calling me in a panic when I have had $11 charges at my usual Publix, and when I have my regular, monthly appointment with my physical therapist, so I have had some misplaced sense that they might be sensitive to a report of fraud before the fact. Further research shows me that Wachovia has had class action suits against them for this sort of fraud, which makes me need to be extremely pro-active. I called Wachovia to fend off this charge in advance.

    Instead, the first service rep read me a Wachovia Memo, telling me that they communicate with Shopping Essentials, and that I must have clicked on something on the internet which gave Shopping Essentials the right to use my account. They told me that Shopping Essentials is a legitimate company. And that Wachovia would honor all charges to Shopping Essentials unless I closed my card and opened a new card.

    I asked for a supervisor. The supervisor, Miss Geck, confirmed all the CSR had said. She instructed me (according the Wachovia memo) to call Shopping Essentials and cancel the fraudulent charges. She gave me a new telephone number (which wasn't open). And told me to respond to the email and try to cancel it from there. She told me that I must get the account / card to which Shopping Essentials planned to charge me before Wachovia would do anything. Experience has shown me they are not good at fighting or reversing actual fraud, so I wanted to avoid it. She said that I had to know exactly which account was going to be charged.

    Despite my reluctance to call the company or to click on any email, I felt I needed to follow her instructions, because it was clear that Wachovia's so-called fraud protection was useless. It also seemed that they were complicit in an arrangement with Shopping Essentials. I objected, and made it clear I was taking notes and typing, and read her back what her instructions were. Most of the time, she read and talked, and refused a two-way conversation, always talking over me. I have contacted Shopping Essentials, with great trepidation. They had all sorts of information on me, but NOT my telephone number.

    I did cancel online. However, this does NOT feel legitimate. I fear the upspring of all sorts of possible internet fraud from now on. Where did they get this information? When I joined CostCo? When I bought from Sears? I am very protective of possible identity theft and am quite distressed that Wachovia offered me no protection.

    On 4-24-08, we trustingly deposited a $1,000 cashiers check into the ATM. Apparently, the check was lost & the bank would not give us the money. Because the money was an award from arbitration, the payer would not help us. Branch mgr. Diana W., operation specialist, Meco C., Premier Client Mgr. Mike S. & Martha D. from the executive office were all unhelpful. We filed a complaint to the OCC & they supposedly contacted the bank. However, they have not received a response yet.

    I filed an Affidavit confirming that U.S.Cellular placed unauthorized charges on my account. Bank of America had returned two of the three payments on 7/29/08. On 8/05/08, U.S. Cellular resubmitted payments and they again were withdrawn from my account. When I asked Bank of America why they allowed the payments to be resubmitted even after I have a signed affidavit stating these are erroneous charges, they claim that they cannot stop them and because they are still investigating the claim, they was nothing they could do.

    Bank of America claims to offer security protection, yet even after following the necessary steps to resolve this problem; the payments were paid in full, from my account. In the end I had to borrow money from my parents so that I could be there for the surgery that my father was having. Although Bank of America and U.S. Cellular were aware of the problems they were creating, there seem to be nothing they could do.

    I soon could be loosing much more then money since the total of unauthorized charges were $551.09. I am sure there will be nothing they can do about that either. I will be closing my accounts with Bank of America, and stay away from both U.S. Cellular and Bank of America.

    Over $551.09 has been withdrawn from my account. Many other bills are being place on hold. Closing of the accounts means changing deposits and scheduled bills to a new bank. All of which takes time. The worse part of it was the rude, shameful treatment from both of these companies. Bank of America's rude remarks Were not letting them do anything, yet U.S.Cellular has received all three payments in full.

    I purchase a 4-wheeler through Bank of America. They were the financual lender with the dealship. After paying for the item in full. In 2005. Come 2008, they claim they can't find record of payments. Although payments were made by money orders to Bank of America and a couple of cash pymts to Bank of America in Champaign,Ill. The Bank of America can't find my account nor payments made, but can find my date of purchase, now image that! You can track and find a purchase date, but no payments and your going to wait three years to find out why payments haven't been made and not send any letters or repo the item?

    Then the Bank turns this over to a collect agency and they are threatening to take me to court for the amount. In the meantime, this was purchased for my son his senior year in highschool. Immediately after highschool he join the active army. I sold the 4-wheelere and gave the title and registion papers to the purchaser. And threw away the loan papers now how do I prove payment of. Or do I have to pay for this item again?

    I have two checking accounts with BOA, a CampusEdge checking account and a regular checking account. I use the student checking account for my finances and the regular account for Ebay purposes. I have been transferring money from one account to the other to take care of ebay expenses. About a month ago I went to the bank and deposited money into my student checking account. I use the online banking website, so later that evening I accessed my account, confirmed the money was in the account and proceeded to make three seperate transfers into my other checking account for ebay expenses.

    The next day I had three overdraft fees ontop of what I had transferred due to the fact the deposit was posted after I made the three transfers...I have one question...How could I possibly transfer money that was not even in my accont? I can't seem to come up with a good answer and neither could the representative I talked to from BOA. When I called to find an resolution to my problem, I was a little disturbed that they could not verify my account. In the past I have called the bank many times and had never had a problem. I am not sure how my information got confused, but this was a big inconvenience.

    After going through a hassle and finally using a different method to verify my account, I was told I would have to go into an actual banking center to fix the situation that I did not take part in messing up in the first place. When we finally discussed the actual problem of my overdraft fees I was made to feel that it was my fault although they did not give me a good explanation of why I was charged the overdraft fees. I was told I would be reimbursed one of the overdrafts as a courtesy but that was all they could do. I was very dissatisfied with the customer service.

    On another occasion, which was very recent I made a deposit on a vacation home in Florida for $261.29. After I booked the vacation home I checked my account and confirmed that they had debited my account for that amount, which indeed they did. The next day, I did a routine check of my balance and noticed I had more money than I expected. When I accessed my account online the vacation home deposit was not there at all when I am 100% certain it was there the day before. I contacted the business in which I had booked my reservation with and they confirmed that my reservation went through and the deposit was paid.

    I have no explanation as to why that debit has disappeared off of my account activity but luckily I am keeping track of this activity better than BOA is or they would have another reason to charge me another overdraft fee. I honestly feel it is a disgrace when you feel that you can't trust your bank, I have been with this bank for a long time, but now I feel that I am going to have to bank elsewhere. I am no longer able to afford to have an account with these people.

    For the three overdrafts I was charged I was reimbursed for two of them, which I was pleased about, however, I didn't see how it was my fault to begin with so I really shouldn't have had any. I am taking this as an economic loss along with the many other overdrafts I have been charged in the past due to the way they post transactions. I have not yet gotten to the root of the problem regarding my reservation deposit.

    This is the rudest bank ever. The tellers! The Call center! I feel no one is montering this bank. Everyone is rude! I just want to let others know. They never go out of there way and make me feel as if I am luck to be banking with them. I have had them for one month and that is to long.

    On 8/08/08 I had 50.88 in my checking account. I had placed 4 debts on 8/06/08 in the 1) 18.82 2) 2.12 and 3) anther 2.12 both from a dvd rental site. the fourth was 8.30 . on 8/08/08 my rent check came in faster then i thought it would for 310.50( i thought it would hit the monday of 8/11/08 as I had just mainled it on 8/07/08. anyways the bank took the rent check and paid it first out of the 50.88 in my account and made the other 4 small debts that could had been paid , over draft too, charging me 35 each overdfrat for a total 175.00 of 5 overdrafts.

    Had the bank paid the small debts first out of the 50.88 i had in the account they would had never had over drafted but WACHOVIA paid the 310.50 check first to take the 50.88 balance I had in my bank to cover those 4 small debts. I also depostied 900.00 dollars, 600 on friday night of the 8/08/08 and 300 cash on 8/09/08. this bank needs to be forced to change their banking to pay small debts/checks first before paying a large debt/checks to make a account be overdrfted by many over drafts. this is the second time this has happen to me. well nomore. I am switching to PNC Bank as soon as all my other online bills clear this week and a check i wrote.

    I am now left without money for gas to get to work and or buy food..once all my other debts. online bill pays i have that will come on between the 12 th and 19th, That will leave me with under 25.00 dollars, where had wachovia only charged for the rent check that i know was my fault i would had only been short the 35 charge and not the 175.0

    Every time I deposit cash to either branch and any clerk they tell me the funds are immediately availabe if posted before 4pm I will have immediate access. They then change the dates of my deposits, only let me have access to $100 of it, and claim the deosits were made at a later date or that they told me a different availability time. They are sending the deposits to another branch to be verified and posting them the day the other branch agrees that the cash exists.

    I don't even try to deposit my paycheck there anymore. They hold those eve longer. And since they change the availability of funds they charge me overdraft fees on top of that. Cash is much easier to pay my debts with than having to wait for the banmk to credit cash to my account.

    Currently I have $120 dollar overdraft fee I have had to pay for this transaction. I had a $1700 check out that couldn't be cashed and upset a vendor I work with. I had to show him my online statement proving that the money should be there. I had to give him the $400 cash I had on hand to pay for my children's dental appointments and rewrite the check for $1300 so his boss wouldn't punish him for the problem. This vendor may never work with me again.

    I can't trust that the bank will post my deposits in a timely fashion and I'm having to cash my paycheck elsewhere then deposit cash only when I have to write a check. I will have to change banks again. There have been several other overdraft charges when I had deposited cash.

    I bought a Kia minivan financed through Wachovia Dealers February of 2005. I have made online payments and they posted just fine. However, when I made payments with checks over the phone they would always post as non-sufficient funds. We payed several late fees as well as returned check fees. I finally called my banking institution and spoke to them about this problem. They said that they had never received any checks from Wachovia and furthermore, we had never overdrawn or received fees from our bank.

    When I called Wachovia and told them that they had never actually processed the checks they returned only a fraction of the fees (117.00) to be exact. When I asked why they didn't return all of our fees they said that they couldn't go that far back and also that they were only doing this as a curtesy to me! I didn't continue to argue so I faxed them a letter to change my due date which Destiny said would be scanned and processed. She said my new due date would be on the 18 of each month.

    Three months later and I come to find out my due date was never processed and now I have accumulated three months of late fees, and they don't want to return the late fees. Can someone please help me deal with these problems? I don't know how else to handle this. All I get is the supervisor is unavailable and he'll give you a call. I'm still waiting.....

    The economic damage is that we have a lot of late payment fees that have accrued and our total car balance is not going down the way it should be. We bought the car for 24,000 we gave 2,000 down and we financed the remaining 22,000. We have payed 406.30 for 30 months now and our balance is still 16,800. Please help us.

    I attempted to close my bank of america checking and savings accounts. It takes hours to get a person on the phone. I finally did. I sent several email messages regarding this with responses. I wrote a check to myself to get both accounts to $0 exactly, and then they contacted me and said I couldn't close the account because I was .97 under. They waited until I hit 0 and then did a keep the change transfer of .97 cents and then charged my savings account for being at 0, which was what they told me it needed to be in order to close the account. This was after I had notified the bank in writing and on the phone for over two weeks that I wanted to close down the account. Kevin, a supervisor who refused to give me his last name, said they wanted to charge me all these over fees for being at $0 but he was going to be nice enough, so as to not charge me.

    THey wouldn't let me pay the .97 cents to close out over the phone. They said I had to send a check, because I am not in a state that doesn't have bank of america. i asked him if he could promise me that once again if I got it down to $0 by sending the check in the mail, if he could promise me that they wouldn't do it again (charage me fees for being at $0) and he said no. I have checked online and this seems to be a common occurence with other Bank of America customers. I do not care about the 97 cents, but the behavior is very unethical and this disturbs me even more so because it seems systemic.

    Countless hours on the phone. It is very difficult to get a person on the phone. And sometimes they just hang up on me. Stress. Anger. feelings I am powerless and being manipulated. Worried about my credit score.

    I have been a customer of Bank of America's for a number of years. Recently, I began incurring overdraft protection just prior to every paycheck period. I wasn't doing anything any differently. I don't keep a register... I log on on a regular basis to check my balance and spend money accordingly. I went into a branch a couple of weeks ago to ask a CSR to explain which transactions were causing the overdrafts and low and behold, when she pulled up her system, it's completely different than what the online customer sees. The online transactions are apparently not in chronological order so the customer is not able to determine what caused the overdraft.

    For example, I logged on on Thursday (8/7/08) evening and viewed a number of pending transactions. The ending balance, including these pending transactions, was 300-something dollars. In addition, I was to receive a paycheck via direct deposit Thursday night (as has been done for years). I woke up Friday to see plenty of money in my account - more than enough to cover all transactions - right along with a $100 overdraft. How could I have possibly incurred an overdraft with a $300 balance AND a $1200+ paycheck that posted sometime during the night? As a matter of fact, looking at the way items posted to my account today (Fri, 8/8/08), the balance that's posted just prior to the overdraft transaction is $1814.07. The balance jumped up to $1914.07 after the overdraft. Now, how is that fair to me that I can't even determine when or why that overdraft kicked in? It's not! It makes absolutely no sense and someone should do something about the way BOA is conducting their business.

    Since my overdraft is hooked up to my BOA credit card, the bank charges 10% with each overdraft, even if I immediately transfer the money back to the credit card. I still can't figure out which transaction caused the overdraft. In this particular instance, I did notice that one of my mortgage payments was suddenly posted to my account even though it NEVER appeared in the pending transactions. How can this be legal, ethical, accurate or fair to the customer?

    In addition to owing money and fees to the credit card and bank, and in addition to the frustration, the consequence is that BOA is making millions off their customers' lack of understanding on how they're conducting their business. They're relying on the fact that people can't see what's really going on in their system. It's unethical.

    I was in the bank with my payroll check. The check is draw from [Bank of America] and I was told that if I didn't opn account with [them] as of Sept. [they] would charge me 6 dollars to cash it. Doesn't my company give [Bank of America] money to take their business? Loan sharks charge less.

    I recieved a call from a salesperson, I don't know her name, but she offered to give me a free trial for this BAC Security Assist. She said it is FREE for a month so I took her up on her offer. She also said that if I liked the Security Assist program that I can sign up for it later on after the trial. I said OK I will just take the free trial for now. Well I just looked on my credit card statement and what do you know? There is a charge for BAC Security Assist for $12.99.

    I don't want this service, never asked for it and quite frankly would like this charge taken off of my card. I have much more important things to pay for than this Security Assist on my account, so you should reimburse me for YOUR or HER actions.(Whomever signed me up w/out my permission!) I NEVER wanted to be charged I took the FREE Trial not the membership! The $12.99 charge on my card for a FREE TRIAL!

    I have a complaint. I have both worked for and been a customer of Bank of America. Now, the problem I have is that on two occassions in the last year I have had a debit on my account that I was not aware of at the time. The first was because of a double refund from fraud on my account, that account was closed and a new account opened. The second debit, I am still waiting for word from the bank as to why.

    On both occassions the first word I get of a problem is a call from SRA a Collection Agency. In this last instance I went directly to the bank to find out why I had a debit as my final statement said zero. It has teken them over 4 days to get an answer for which I am still waiting. I then had a confrontation with the SRA representive who called me a liar and threatend my credit. Told me it was my fault that I had ignored bank letters. This is unacceptable, I would accept that in the first instance that I might have over looked Bank notification, but not twice in less than 8 months.

    When I tried to contact someone about calling off the collection agency I was told they can not do that till the debit is paid. I pay my debits and all I want is proper notification and proof of the debit. Instead I get the run around and told there is nothing anyone can do.....this again is unacceptable....if you can start a collection then you sure can stop one. I do not like being treated as if I am a criminal and trying to defraud the bank. I would welcome a call from the President of the bank to explain the banks position.

    I remember once the President of the bank came to the call center where I worked and said Bank of America had gained 3 million customers this year after the cheers died down he said we also lost 3 million customers. I am one of those lost customers and I represent at least 50 other people in my large and extended family that I will make my mission to never use BoA. I will from this point on be a vocal advocate against BoA. Lets see if you can suprise me; will I get a call from someone high enough up the food chain to make a difference? I am a little pessimistic.

    Right now it is just time. However my credit is being threatened and I am being labeled a liar. I have spent over 32 hours trying to resolve this.

    I deposited an certain amount in the bank, knowing exactly how much I have to what I recently charged my account to. That day, the 28th, I stayed above the account balance, even more than I charged to the account. The following day, I o my account negative $5.42 that I was not aware of. so I called the 800 number and spoke to a lady. I simply asked in different ways so she could understand me, "if I deposit 6 dollars into my account will this deposit reflect my current balance where I will not be accessed any fee?" she said "Yes". I do not know why, when I deposited 20 into my account that I was already charged a fee that same day I poke to the lady.

    I had to call again the same day. This time I poke to another lady, and asked her about my first fee of $25 dollars. The second rep. told me that the fee will be revered a courtesy, but she did not know where the fee came from then said it was from a transaction charged on Monday. I simply told her that when I deposit the amount, I made sure I stayed above, and that charge was an already part of the account since that count pending transactions. Again it was because of the transaction on the 28th. The following day after the absurd transaction fee, I was accessed two more fees because when I thought I had the money in the account I didn't. They charged my account when I had an available balance, so when I thought I had money, I swiped my card and went negative because they already charged my account when it was positive.

    Of course, I tried calling the bank again, but like always I had a representative who did not know what they where talking about. she said the fee was for something other than what the first rep. said. Again, she couldn't assist me. Now that I am negative I can't deposit any money in the account to make it go above negative. Another rep. said I couldn't deposit any money in the account to avoid fees. That she didn't know what the other rep. was talking about. Finally, I went to the bank that originally opened my account. The Rep from the bank wasn't sure either about the original fee but was consistently stating that I will have more fees, 3 more to be exact applied to my account. In total that was already $195 dollars in fees to my account. I asked her if there was anything she could do since I was told from the reps at the call center numerous of wrong information. The answer was no.

    That day, I had an available balance before the future fees that did not get posted yet. I took out the rest of my money and the balance ended with 2.52 cents. Now, the rep that was helping me seen my balance. Now the bank just charged me another fee of $35. Totally the fee amount of $230. I called before the fee posted to the account today which was yesterday. I spoke to an Rep and her supervisor. The supervisor said I was charged due to an transaction not yet posted to my account, that got posted a day later the fee went through. I asked the Rep, if the web can be the only way I can view my activity going on in my account, and you are saying that I cannot trust the statement, then what do I trust and used. I do not think it is valid and ethical way of business to charge the account for pending transaction that are not posted yet.

    On top of that, like I said I got another fee and I think it is because I withdraw the money I left after the first 6 fees. I know that the bank charges transaction from the largest the the smallest even counting withdraws due to my proven activity. But they charged the three fees first than the with of over 300. If it says, after the fees I had -105 dollar, why would the bank let me take out 300 dollar on top of the negative? They wouldn't and the withdraw should have been first and the fees last, but it wasn't. They tried some way to get my money. Even though they put back only 100, I am still out of 100 and change, money the was deposited into my account of money I worked for...money that is for rent. I have not seen any consequence yet, but will. I needed that money for rent and to pay for my child's sitter, and other bills. I am not sure what to do or how to resolve this matter. No one will give me an answer.

    False information given to me re: Credit Protection Plus program. Cancelled over the phone on multiple occasions but fees kept accruing. Wrote 2 letters, one to general statement address & then to actual CFO of corporate. Asked to be refunded for total amount charged plus interest due to fraud. Refunded partial amount only.

    Corporate (which was just another call center) would not listen to my concerns when I explained the logic of why I would pay an additional $200.00 a month plus finance charges on top of already high balance when I couldn't afford my payments as they were, yet I had continued to pay. Obviously I would not agree to such a ludicrous set up had I been given the full story up front of the charges.

    Currently earning under $900.00 per month and unable to pay for services I cancelled multiple times.

    "OVERDRAFT PROTECTION" RACKET. Are you a victim of the "overdraft protection" racket? Did your bank just charge you $35 to "cover your overdraft" of $1 or more? When they honor a purchase on funds not in your account and then charge you $35 "fee" they are really giving you a loan for that $1 or more and then charging $35 in interest payable immediately. That is also known as usury and it is illegal and immoral! This technique used by bankers to rob your bank account makes Al Capone look like a saint in comparison.

    After they do this to your account you will have the domino effect, and you wind up with four, five, or more charges before you find out what happened to you. Then they accuse you of not keeping up with your balance. Even if your are not writting any checks (they may take longer to get deposited) the bank has the audacity to reprimand you for depending on them to give you an accurate balance of your account. They tell us: How should we know?

    And how safe is a bank that cannot give correct information on your account (when you do not have a credit card, but a debit card on the account)? A debit card you thought was just that...if you have funds in your account you are debited for the amount of purchase, if you do not have the funds in the account and you purchase is for, let's say, $5 you surely want that purchase to be declined as you do not want to wind up paying $40 for that fast food sandwich that gave you indigestion. Now you have indigestion all over again.

    So a deposit of $800 was not put in your account the day that you made it (Friday) for various reasons that the bank can come up with to have it show in your account the following work day which may be Monday. Well, you are not aware of the tactics of these thiefs. You think your money is safe and that your deposit was put into your account. Now you start using your debit card over the week-end and make twenty purchases totaling $790 leaving a ten dollar balance.

    Thursday of the following week you get a postcard in the mail that says that you are being charged overdraft fees of $700 for purchases you made over the week end. The bank was "being generous" with you in honoring purchases that you made, according to them, on an account with insuffiecient funds.

    How is it that they are able to know you made all these purchases but not know that you made a deposit? And why no urgency on their part to inform you via e-mail or telephone (which is free)? Well, because you just may make some more deposits (and then they can take that $700 usury charge before you know what happened) and more purchases that will also be subject to overdraft fees. This is where you have the domino effect.

    What kind of system can only recognize withdrawals first, with the biggest dollar amount first? That is the computer software system that they have deliberately set into place in order to profit from these so-called "fees". They do not want the "regulators" make them change scheme. This is worse than highway robbery, as you are not aware of it until about three, five or more days later depending on the Post Office and how often you pick up your mail.

    Will going from one thief to another do any good? Is there anything that you can do to retrieve your hard-earned money from these thieves? The only thing that works if they will not return 100% of your money is to take them to Small Claims Court, where you yourself can act without a lawyer. You should have the court subpoena the teller who waited on you, the customer service representative you initially complaint to, and the branch manager of your bank branch. While you are in the heat of this thievery and are awaiting a court date, you should write letters exposing this scheme and demanding that the system be changed, to every publication, newscaster, and consumer protection agency.

    My husband went to the teller to inquire about a wire transfer that we have pending from another source. Our source advised us that the wire transfer went through but for some reason it was still pending on Bank America. The teller was nice and advised my husband that she will get a manager to better assist us with our concern. The assistant manager did approach my husband, but unfortunately not with a professional manner. Lenita D. seemed uninterested in her bank customer. Could it be because we are Hispanicis?

    Mrs. D. was unprofessional, did not demonstrate customer service, has no people skills, and should not even been consider for such position with out having adequate training when dealing with multi-cultural people in the area she works in. While we do recognize that the area we live in is prodomitely White American, we also recognize that the population of Hispanics is growing and Mrs Lenita D. needs to realize that changes in her work area is good. Good for the economy, growth, and many other things.

    We have never felt such aggression from such a high and reputable company like Bank of America. Mrs. D. needs to wake up and realize that she has a high position and represents a Bank that is composed of many races. While we do realize that we can not change peoples feelings about other people, we do know that we can not expect this from Corporation Businesses. Felt humiliated, embarrassed to be treated in such matter, and disappointed. The "Assistant Manager" Lenita D. raised her voice and it was obvious that everyone in the bank found out that she was not looking forward in assisting us with our matter.

    I deposited $150 into my savings account via ATM. It reflected in the account the next day. However, after 2 days my account showed $150 missing out of the ATM because the money wasn't found. So now that money is missing out of my account. If they could not tell the difference between CASH and ENVELOPE, why have such service? How can we be guranteed and satisfied that next time we make a deposit our money will be safe?

    It is more of a mental damage and waste of my minutes that I have to constantly call for assitance. Plus, they take forever to answer. How can this bank be trusted?

    I use them because I have to but in actuality they are costing me a fortune that I cannot afford. The first few years that I would call to inquire about the overdraft fees and the rearrangement of purchases on my account, I was treated like I was crazy and given the runaround. Sometimes I was told I would receive a callback in which I never received, ever.

    Finally, this year I am told that the charges are placed in order from largest to smallest at the days end, due to customer complaints in the past concerning nonpayment due to insufficient funds on items such as a mortgage payment that customers preferred to have paid as a priority as opposed to a smaller charge on their account for that day. I disagree and was told that process was soon to change due to increased customer complaints. The next call I made in reference to overdraft fees, I was told that was indeed NOT true and was not going to happen. Wonderful, back to the old routine of me being crazy again.

    I have also sent many e-mail correspondences in hopes of a more accurate solution or answer to my problems. This too never happens. I get basic replies to do not solve my problem and usually do not answer my question. It's like they pretend I am asking something different than what I am. I have placed several request for the total amount paid from my account to the bank for overdraft fee charges each year that I have held my current checking account active. Each and every time I get I would be happy to assist you with your request......then all I get is instructions on how to view my account, which I already know how to do. I believe it is over $5,000. per year, this is absurd. No matter what I do there seems to be a loop hole that sucks out the fees.

    My consequences are being BROKE most of the time. Having utilities cut off. Not having Christmas or food money, that is in my account but I can't access any of it. They placed a fraud alert on my account because of increased spending the day prior to Christmas Eve. Not having all of my house payment because they charged me 5 overdraft fees in a day. Not having what I need when I need it for my children.

    Okay, last week, I completed an application to open a new Bank Of America MyAccess Checking account. I already had 2 other checking accounts with them, along with a savings account and credit card. Well, anyways, I completed the application for the new account and set the openeing deposit up to be taken out of my current checking account, the amount was supposed to be $40.00. A few days later, I log into my account and see that the new account is open and has a balance of $4000.00. My original checking account had a balance of $59.00.

    I called the 800 number and the rep. told me that it was a coding error. They had taken $3,400.00 off of my credit card and $560.00 out of my other checking account. She said she would fix it, she left $40.00 in the new account and transferred all the money, which was $3,960 back to the original checking account and then she transferred ALL of the $3,960.00 back to the credit card when she was only supposed to transfer $3,400.00. I lost $560.00 to the credit card.

    I have called in and have spoken with several reps that claim that nothing can be done and the other half of the reps tell me they will correct it and note it in the account. I called today, the guy says there is no record of anyone doing anything and that I can't get the $560.00 back. I dont' know what else to do?

    I have been a customer of BOA for over 20 years and it seems lately that the banking services are getting worse Something is going on with BOA and I am not sure quite what. Within the last 2 years I have paid maybe close to or more than over a $1,000 in banks fees. I am not the best budgeter nor am I the worst. Just when I think I have my budget figured out, I sit back and wait for BOA fees, because I know they are going to find a way get money from me. Every paycheck is frustrating, because I know that BOA is going to take their portion. Recently, I made some transfers from my savings to my checking account to pay some bills.

    Days later I deposited a check into my checking to find that BOA had taken over $70 in fees. I called the bank and was told that every customer knows that you have 3 times to make transfers in your savings account--this is a federal law. Also, BOA gives you and extra 3, totaling 6 times to make transfers from your savings account before they start hitting you with fees. Wow!

    Do you actually think that if I was told this or read the fine print (if there is fine print) that I would've freely given BOA my money? I am beyond frustrated and someone needs to launch an investigation with BOA. I am almost positive many people feel like me and I owed plenty of money. I am a single parent and I can not afford to make BOA a priority over my children. Economic damage was bank fees for not reading the fine print.

    I have been calling Bank of America to cancel my Credit Protecion Plus Since i did not approve or gave the ok. I just relised it when i kept getting an over the limit charge. Not only that, Even with auto pay and them getting their money monthly the closed my account and stated that i had to much debt. i have called several times and e-maild them only to be told the same thing. call the 1-800. i will be taking to a lawyer to see what can be done.

    Over the limit charge and had my credit cards closed for to much debt.

    At end of business day on 7/29/08, we had a $6.24 balance in our checking account. On 7/30, and not until mid-afternoon, (2) $35 charges appeared on the website againt the account. When I called to inquire, I was told by a BOA customer service agent that these were (2) overdraft fees for activity on 7/29. How could that be possible I asked if I had a $6.42 balance at the end of day on 7/29? The agent said that BOA now includes any pending transactions even though they have not posted to the account. How is that possible or legel for that matter?

    Bottom line is, the transactions were never processed and were still pending as of 7/30. The agent explained that letters were sent out by the bank to inform customers. What difference does that make? I don't believe what they are doing is legal or is an ethical business practice. How can I manage my account? Additionally, I knew our account was very low and had checked it several times that day. I had asked my husband not to use the ATM card for anything until my paycheck deposited on Wednesday. The last time I checked it, INCLUDING pending transactions, there were a balance of over $10.

    Even so, the bank website itself shows our balance above zero. How can we be charged $70 for overdraft fees if the bank has not yet paid on that transaction? Something is not right with that. Unfortunately, I do not have any screen prints from 7.29 but I do have screen prints now showing a positive balance on that day.

    Economic damage is that we have been unfairly charged $70 when we still had a positive balance in our checking account.

    I opened a CD account online four days ago on BofA's website. I have been a customer of BofA since 1970. I have two savings and two checking accounts, plus a mortgage. The CD was to be funded from money on deposit in one of the BofA savings accounts. Because my credit report is locked (per California law) the bank wouldn't open the CD. It is locked because I receive as many as fifty credit offers a month.

    Other than the hastle of changing banks, I wasted many hours trying to resolve the issue. It is also possible that they offered a high rate CD and realized it was a mistake, so they found a reason to not issue a CD, because the higher rate is no longer available.

    Long story short, FIVE times within a course of one year cash deposits have gone 'unregistered'...not showing on account after physically walking into the bank and dealing with a teller NOT an ATM. Of course.. the cash showed up immediately as available that day..a day or two later the deposit isn't even listed on the statement or recorded anywhere. THANK GOD for holding onto receipts.

    I will be pulling my account with them shortly! I have been with BOA since United Jersey...then summit. Since the early 90's. Almost two decades. And this is how I'm treated? Needless to say, I have called the OCC and am waiting for papers to file an official complaint and an investigation will be done.

    I really rather not mention the headaches this has caused... in having to straighten out NSF fees as they seem to be popular in doing.. Bottom line.. Something fishy is going on at BOA.. so let's all file an official complaint and show them we, as long time consumers, will no longer tolerate their misappropriation of our funds.

    i applied for a loan on june 25 2008, i already had a loan which i owed 38k on, i was extending the loan to 67k so i was borrowing 29k. It is a home equity loan which wachovia already has the deed to my house, now heres why i'm so mad!

    it is now JULY 29TH and the money still has not been deposited into my account! ITS BEEN OVER A MONTH!!! i am a very good customer i've been dealing with this bank since it opened my credit rating is 817 OUT OF 850 PLEASE SOMEBODY EXPLAIN TO ME WHY IT HAS TAKIN OVER A MONTH TO GET A LOAN? I am so angry i can't sleep, if this is the way Wachovia treats its excellant customers how are those others treated with bad credit?

    i would like someone up the Wachovia banking ladder to read this and to have an impact on future transactions, this is absolutly embarrassing. A MONTH TO GET A LOAN C'MON. One more thing! i was charged $116.00 for title search,and a couple of other charges that were added , these fees were paid when i did the firstloan and Wachovia has the title so why am i being charged for a title search?

    When we opened the account the interest rates across the board was 4.9%. We got a cash advance of $7500.00 in fall of 2006 and have been paying on it with auto debit two weeks before due date. For 6 months we paid twice a month. The interest rate on cash advances was raised to 24.9% two years later for no other reason than it was considered an unsecured transaction and they did this to all their customers. They said they sent out a notice... a year ago!

    I had paid $2000.00 of that transaction and my payment was down to $80.00 a month even though I consistently paid $110.00 per month. With the increase my payment went to $191.00 month with $122.00 being the interest. They should not be allowed to arbitrarily change contracts without active agreement with consumers. Not the backdoor options they use. I could understand it better if after they initiated the increase if we had used the card then apply the new terms but not on existing balances.

    Our payment history and credit rating is very good. My husband's is exemplary yet they still did this. They even cheated us out of part of the overpayment claiming finance charges which I had them apply to two days after payoff date so there would be no issues.

    We are on a fixed income as we are retired. The increase was not doable so we used our savings to pay off the account and now we have nothing backing us up in case of medical or any other kind of emergency. Vehicle breakdowns etc. Now we stay home because we cannot risk an unforeseeable expense. I will NOT be getting my eyes checked any time soon which is well overdue. I have cut back on my medication. What little we have after bills and mortgage payment we are trying to put back to build up a savings again. They took over another $120 a month from our food/gas/medical budget. It is just plain wrong!!

    I called Wachovia AGAIN on the 25th. now I've been calling them wachovia everyday since Monday about my money. This all started from a $2,225 depoist that was going into a closed account. After being told that they won't refund me the $180 from the $447 that they took out of my deposit that they owe me. i called back and spoke to recovery. they said they will go ahead and open my account and send me the difference ($180) which would be quicker than them mailing it to me. So she said I should see my deposit monday into my account. I basically got on their nerves from calling so much!

    Now the next day 26th I called to check and make sure that my deposit $1826 out of the initial $2225 was still being mailed off on the 30th as they claim. they said it has all ready been processed so it will go out with the batch of checks on the 30th. (BTW I also asked them could they just deposit it with the $180 and they said no cause it was processed! Now on the 26th I checked my account just to check it and i saw a deposit processing of $1826. WHAT? They told me it couldnt be deposited. so another lie that wachovia told but I couldnt complain cause I have my money early.

    Now its the 27th and I checked my account and now it says a balance of $1646. now im HIGHLY [upset]. i called wachovia and the rep said they she saw a debit of $180 that the recovery department took out. their suppose to deposit $180 into my account not take it out! So now i have to wait til tomorrow to speak to the recovery department. NOW WHAT IM SO HOT ABOUT IS they lied and told me that they couldnt deposit my $1826 into my account because iT was processed and gettn mailed out on the 30th. NOW THEY was suppose to DEPOSIT my $1826 BECAUSE THEY WANTED TO TAKE OUT THE $180 in which they was suppose to give back to me which they promised. WHEN WACHOVIA WANT TO TAKE YOUR MONEY THEY CAN MAKE IT HAPPEN WITHIN THE DAY. But when they owe you money you have to jump through hoops to get it back.

    Wachovia charges bogus overdraft fees. I made 4 purchases with my debit card. Those purchases were deducted from my account and put on hold. When they finally cleared, Wachovia charged me an overdraft fee of $35 four times for a total of $140.00.

    I live paycheck to paycheck trying to make ends meet. That $140.00 was for my electric and groceries for the week. Now my electric will be late and I have to borrow money to eat.

    I used a Wachovia ATM machine on Saturday July 19, 2008 with my husbands COMDATA card, I left the card in the atm by accident. On Monday I went back to bank during business hours to have the card back I had ID and all the information I needed, my name was not on the card but the company that my husband works for was, they were willing to fax over a letter for me to have the card release, they still did not want to release the card, I was told that I would have to get a new card.

    My gas tank was on Empty my kids needed food I had no money what so ever and they were not willing to work with me. I was told by Christina that the bylaws prevented them from releaing the card, by the way did i mention that I was a customer of the bank. I got very upset I told them that i will no longer feel sorry when I hear bad things happen to tellers. because my kids re hungry i need gas and you are not working with me. I left and called the police at that time I found out that they had also called the police and i was told by the dispatch to return to the bank, a state trooper came and too my side and then he went in and took their side. 30mins later he came out and told me that i am no longer welcome here and i should find another bank. I left to get money from a friend to try and get food for may children and gas..

    I jsut gave up. I rec'd a letter in the mail 3 days later telling me that my account will be close and that i will no longer be welcome at any wachovia banks which i said was fine, my payroll was deposited there on July 25 when i went to take the miney out my card was decline, they have cx my card without telling me I had to wait until i get money to get gas to get to work. because i ran out of gas. How can they get away with that? Treating people that way is wrong. i think I was treated that way because I was black. I would have nerver be treated that way.

    I have been using the electronic bill pay for about a year. I scheduled a payment to Chase Bank for 7/25/08. I am paid at midnight on the 25th through direct deposit so the check would be good when presented on the 25th. Apparently, Wachovia chose to write a paper check to Chase on the 22nd which found its way to Phoenix AZ via US mail on the 23rd and was presented and paid on the 23rd by Wachovia, resulting in an overdarft and fees charged to me.

    I was told that with paper checks they are paid when presented and I am obligated to have the money in my account. Further they told me that when I schedule the payment that I can see that it is a paper check and that it could be paid at any time. I have been unable to reproduce these circumstances on the Wachovia bill pay web site- they always show payments from Wachovia to Chase as electronic and they note that it will be paid on the pay date I indicate. They tell me that they are not bound by the dtae on the check which was July 25th - if it is presented earlier then they must honor it.

    I pointed out that I have inadvertantly taken both personal and merchant checks to Wachovia branches before the date on the check and had them refused. They denied that this was a bank policy, saying that the law in North Carolina required them to accept any check when it was presented. I find it very unlikely that Wachovia would deal with Chase via a paper check (two prior payments from through Wachovia bill pay to Cahse have been electronic debits on the specified date) and in any case I can't imagine that the US mail and the banking system is fast enough to cut the check, mail it, have it get to Arizona, have it received and processed and sent back to Wachovia within 24 hours.

    I do have a copy of the check which makes it all the more mysterious although I can't read the deposit info on the back. Also very strange, when I send a personal check to a bank to pay a bill or credit card I have encountered late fees for checks sent 10 days in advance of the due date - blaming the mail and time required for internal processing. Go figure.

    What was also very distressing from a customer service standpont is that the farther I tried to go up the line to get an explanation, the more intransient and unhelpful they became. At one point I was told that I had intentionally overdrawn my account, attempted to float a check in violation of the law and then expected help from Wachovia.

    Still seeing how many fees I rack up on this. It appears they debited the big Chase check prior to other transactions even though these transactions occurred before the Chase check was presented. I am also without use of my debit card until tomorrow, messing up some vacation plans. I was told very cavalierly that if I used the card I would be hit with additional fees. So far Wachovia has agreed to refund one $44 fee. I'm wondering if that has anything to do with the fact that I have a large brokerage account with AG Edwards which is now Wachovia as well as other checking and savings account.

    We have been going thru some rough times as many are due to rising costs. Well we are finally on a road to recovery until this. We have a checking account with Wachovia last week we made some purchases which were listed as holds in our online banking and deducted from our avail balance. That left us with a 200.00 positive balance.

    Well on 7/22 Allstate hit my Account for my car insurance payment of 246.00. So that results in a 46.00 overdraft and what you would think is one 30.00 fee. No wachovia takes the money designated for the pending holds last week to pay the 246.00 debit. Then proceeds to charge me for 7 Overdraft Fees for the Txn's dated lastweek. Per Wachovia: It is our policy to pay largest debit to smallest debit I said ok that would ring true based on the payment dates but you took money that was already placed on hold for txns a week ago and paid a debit today because it was bigger.

    This is truely an unfair business practice used to add more fees and generate more revenue for the bank. The best part is they call this a Courtesy to our acct holders. Well this courtesy just cost me 280.00. Instead of one 30.00 overdraft Wachovia switched it up behind the scenes and charged me 280.00 for 7 over drafts.

    It's July 24, 8:50am and I called Wachovia to check to see if they actually mailed my check off...cause I can't trust their word for anything. I spoke to customer service and asked if my check was sent off yesterday morning like I was told and they said they didnt see anything about a check. Then, I spoke to someone in recovery and she told me that my check wont be sent out til July 30th. I have bills to pay.

    It takes them 2 seconds to take money out of my account but take over a week to send me my money! Then I asked about the money I was told that they would send me back since they lied about the settlement THEY offered me..NOW im being told it was rejected..TWO DAYS after they they said they took it out of my account but instead took the full amount! I KNEW they wouldnt live up to their word! Since Monday I've spent at least 3 hours of talk time a day dealing with these people.

    On 6/30/2008 I called to check my checking account balance, the system said I had over 1,600 available, I was expecting an automated payment to target to visa to post for 1500, so I went to deposit a check for 4,985.00 to cover other purchases. I made the deposit on the night of 6/30/2008, again, I checked my balance before I deposited the money and it still said I had over 1600 available. Well, the information was wrong, the target payment had posted but did not show on balance, and my deposit did not go through until the 1st, which caused 175.00 of overdraft fees (6 overdrafts).

    I called today to solve the issue because I just noticed the overdraft while balancing my checkbook. When I disputed the 175.00 fee a customer service rep transferred me to a support analyst, Katherine Hunh, but she only offered a 18.00 refund, I told her that was not acceptable. She said that more often than not the bank system does not show when automated payments post until after they have posted, which causes confusion, but there is nothing they can do about it. She was very rude about the whole issue. When I asked her to transfer me to someone who could help she disconnected my call.

    I called again and was again transferred to a support analyst, Brad Vandiver, and he spoke to her about my account and told me that 18.00 was all I could get for the 175.00, when I told him I needed to dispute the matter he gave me this address: Office of the President PO BOX 563966 Charlotte NC 28256-3966 Did not even give a name of a person, and said they had no supervisor available. Furthermore, he said if I called again they would close my account for harassment.

    I am a customer calling for customer service, which they did not provide, and I got threatened with my account getting closed if I tried to seek further customer service. I now plan to present a former complaint against these individuals, and continue disputing the 175.00 overdraft.

    Customer service online for Bank of America charged me for overdraft fees of $35 for NSF when my account was not NSF. I checked my account on 7/21 online at 11PM and nothing was pending against the account and I had a positive balance. I checked again on 7/22 and nothing was showing pending online again with a positive balance. On 7/22 at 1PM I deposited a check for $600 and my account did not show overdraft in fact funds of $100 were available to withdrawl had I wanted to withdrawl. BofA is playing games to get NSF fees that they are not entitled to have.

    i had my account closed with wachovia recently. I had a balance of $447 that need to be paid. So i had a deposit that I forgot about going to Wachovia on July 21st..so i called them and told them about it. I was told by one person that it would be rejected and sent back to who sent it and i was told that they could open the account again and they can take the amount owed which I wanted them to do. I spoke to recovery accounts and the lady said she would let me settle the account for $269 which was good with me. They said it would be taken out on the 22nd and it would take 24 to 48 hours for the account to update.

    That night on the 21st I called online services to get into my online account and they reset it and I got into my account and I saw my deposit processing. On the 22nd I called to check to see if everything was ok..(now on the 22nd I called wachovia at least 4 times to check to make sure things was in order) the rep. told me that they saw that the $269 settlement was taken and the account was active but not open. She told me to wait til midnight for the system to update and my account will be open. I was also told that they set up a express delivery for my card to be sent to me...which I was suppose to pay for and they didnt tell me.

    So its the 23rd this morning and I tried to get into my account online and it said I dont have access..so I called wachovia customer service starting at 7:30 this morning..they told me that my account was closed and they didn't see anything about a payment and they mailed my deposit off this morning..now im ****** and like WHAT? So I had to wait til 9 to talk to recovery so I did...I was told that the account was closed and they sent the check in the mail..and im like why? THEN..instead of taking the $269 settlement..they took the entire $449..so you know I deeply questioned them about it..they told me that they didnt see anything about a settlement so they took the money and mailed it off.

    So I called back again and was told the same thing..no settlement is on file.and the lady told me I would have to go to a local wachovia and ask them if I can open another account! I dont want an account anymore..wachovia lied! So finally I got with someone that kept their word..I spoke to a customer service rep. and she looked into the account and said it was close..but she did say I DO SEE A SETTLEMENT MADE FOR $269 on the 21st..so she put me on with someone in recovery..and the lady i spoke with in recovery said they deleted my account off the system..so she did some diggn and found it. She said she see that i was offered a settlement and said IF WACHOVIA OFFERED AND AGREED TO A SETTLEMENT..THEY SHOULD OWN UP TO IT...so she put a request to mail me the difference.

    I HAVE no problem payn them back..they offered the settlement and we agreed..I was [upset] cause they was lying saying that there's no record of a settlement being made..now I just have to wait to see if they will send me the difference. I was expecting my money when they told me i would get it cause I needed to pay bills and go to FL to move my furniture out of storage..Dealing with wachovia and being stressed..I couldnt go to school yesterday night. It was very frustrating calling them numberous of times and getting different answers and lies.

    I feel that overall, Bank of America is a lousy bank. I used to deposit my payroll check into my checking account. I wasn't notified that it was put on hold until I got a little card from Bank of America notifying me the following week that my payroll check would be put on hold because the bank that handled my payroll was out of state. During my hold time, I would use my debit card and my online balance would be in black with a positive balance. After my check would be released, I would find myself paying for a few overdraft fees and I would also find those transactions with totally different numbers than the day before.

    I signed up for a savings account and also the Keep the Change fund. Sometimes the change coming out of my account will be two to three dollars sometimes it will actually be the change. So why are there such differences? I had also signed up for overdraft protection. The bank manager in my area had suggested that I transfer 25.00 from my checking to my savings at the first of each month. He told me to try it out. So I tried it out and I wasn't thrilled with it only because the first of the month is financially difficult for me and $25.00 can either make me or break me.

    I called the 1800 number and spoke with someone and told them that I either wanted to change the date-which I could not or I wanted to cancel. She informed me that I would have to keep a daily balance of over $100 or else I would incur fees. She said basically the auto-transfer was protecting me from the fees. I was furious. I asked her why I had not been informed of this and was told to try it out? She said sorry but was condescending and rude as 98% of Bank of America customer service reps are. Bank of America also allows customers to use their bank cards even when they have a negative balance so as to rack up all of those overdraft fees. BoA is awful.

    When I lived in Kentucky I delt with a local bank. I was never in the red nor did I have all these ridiculous fees. As soon as I am able to open an account at a local bank and transfer my bill pay and accounts to it, I will promptly close my BoA accounts. I am worried though, I have heard that even when people close accounts, they recieve fees with little explanation.

    In the two years that I have been a customer with Bank of America I have paid over $1400 in fees. Many of them I have contested for being double fees on one transaction or for putting my payroll check on hold. Just for examples. My family and I live pay check to pay check. My husband and I are both students. When I'm hit with five or six overdraft fees, that's food that is taken away from my kids.

    On Thursday July 17th I withdrew $7000.00 from a savings acct I had with WAMU to cover excessive expenses we were incurring. I had them give me a cashiers check so that the funds would be available immediately. On Friday(18th) I went to BofA to deposit it. I was told because I had been previously overdrawn (at the time of the deposit I was not) that a 10 day hold must be placed on $2000.00. I said that's ridiculous I deposited CASH. I was told they had to go by what the computer said, oh well call customer service.

    I went home and called customer service and they told me to take it up with the bank itself, they had the ability to fix it. Now where am I? Waiting for a response (I'm told don't worry the money is available on the 29th) and not able to pay bills. I e-mailed the corporate office and have had no reply. They tell me they have a right to make a judgement call with my money since it's in their bank. WOW!

    I'm sitting here with a $1000.00 bill due today (22nd) unable to pay it, unable to get food and gas and no money until Thursday (24th) yet I have $2000.00 sitting unavailable.

    On Thurs 7/17 Bank of America put a hold on my accounts. I contacted there Customer Service Dep't immediately, I spoke to Rep Yencia stating that she had no information as to why my account was frozen. She gave me the number to Risk Closure. I contacted them on Fri 7/18 after 9:25am and i spoke to rep Derry who refused to give me the reason as to why my account was on hold. She stated that I would be sent to Check systems and there is an investigation going on and it will be 7-10 days before I would get an answer.

    After battling for 20mins to get some answers she still refused to tell me! She said my accounts would be closed out as of 8/1/08 and I will get my money in a cashier's check along with a letter. I went to the Windy Hill, Smyrna Bank of America Branch and spoke to Jose Argumento on Fri 7/18 around 2pm e/t and again he could not give me answer as to why my account was on hold. Again I spoke to Derry in Risk Closure and still refused to tell me what the situation was.

    My accounts were current and not overwithdrawn. I have not wrote any bad checks. The last check i wrote was to my car insurance company in March 08 and that cleared. I don't understand it. I have been inconvienced, I had no money for gas, food or other necessities for the entire weekend. I had to leave my job early on Fri 7/18 and loose 4hours of work. I hope that my complaint will be reviewed and I can gain some justification.

    I wired $4000 to an account in trying to buy a truck that turned out to be a fraud transaction. Bank of America had frozen the account and assured me that my money was safe. I was told the account was under investigation. A few weeks later I find out that the account had been zeroed out by Bank of America and they don't want to return my money. The person with the fraud didn't get my money. Bank of America has my money.

    First, I want to say that I can now understand why the Feds conducted a raid at Wachovia Securities' offices on July 17, 2008! On July 18, 2008, I went online to check and see if payment for an online purchase I made had been processed, and noticed ANOTHER over-draft fee pending on my Wachovia checking account--this was the second within three days! I contacted Wachovia about it because there was enough money in my account from my employer's direct deposit, both times, so I was sure it was an error. The rep said that a purchase for gas, which did not post until the 17, was the reason for the fee because my direct deposit did not post until the 18.

    I explained to them that I checked my account balance online on the 17, before midnight, AND after midnight, and no gas purchase for that amount was showing, neither had payment for that amount been deducted from my available balance and placed on hold on the 16 (when the purchase was made) OR the 17! The rep said that the purchase was showing as posting on the 17, so I argued that if that was true, that if the gas purchase POSTED on the 17, why did it not show on my account and why was it not deducted from my available balance on that date (I had to remind that this was a debit card transaction and not a credit card transaction)and that before an amount posts, it is deducted from the available balance and can be seen on the account on hold (if it actually posts).

    I then told the rep that the bank knowingly listed that transaction as posting on the 17 when it actually posted on the 18, and labeled it as a previous day's transaction so they could collect the fee, even in spite of the fact that my direct deposit was available well before 2 am on the 18! Needless to say, this SHAM of a bank steals funds by withholding purchases from posting on their TRUE dates, and then posts these transactions for previous, false dates, but well in advance of direct deposits. They also hold purchases made with debit cards when a pin number is not used in the same manner, and then post the purchase to the account when they see they are able to generate the cash-flow from fees charged.

    When they did this a few days before this second over-draft fee scam against my account, I went to another bank and opened another account! (I have now closed ALL my Wachovia accounts). The total amount of money Wachovia stole from my account as a result of their account practices was $60.00 and would have been more had I not removed my monies from their bank and cut up the debit cards I HAD.

    Last year, I refinanced my house with a short term flexible rate loan, with Wachovia Bank and was told after a year I could modify the loan to a fixed rate. It is now before a year, I attempted to address them twice to do this and the loan specialist has told me that my loan is fine on the third time, I called to remodify the loan and the bank tells me they no longer offer that program,

    what should I do because I took the loan under the understanding that could remodify this loan to a fixed rate after a year. I don't want to keep the loan at a flexible rate. I don't feel comfortable with the flexible rate. They want me to refinance all over again. Please help.

    I do not feel comfortable with a flexible rate mortgate. I want to modify and turn the loan as they promise so I don't have to refinance again modify the loan to a fixed rate. before the year is over.

    Last year, I refinanced my house with a short term flexible rate loan, with Wachovia Bank and was told after a year I could modify the loan to a fixed rate. It is now before a year, I attempted to address them twice to do this and the loan specialist has told me that my loan is fine on the third time, I called to remodify the loan and the bank tells me they no longer offer that program, what should I do because I took the loan under the understanding that could remodify this loan to a fixed rate after a year. I don't want to keep the loan at a flexible rate. I don't feel comfortable with the flexible rate. They want me to refinance all over again. Please help.... Kathleen

    I do not feel comfortable with a flexible rate mortgate. I want to modify and turn the loan as they promise so I don't have to refinance again modify the loan to a fixed rate. before the year is over.

    my brother opened a checking account in a wachovia branch, I signed a signature card to be a signer on the account in case of an emergency. this happened about 18 months ago. about 4months ago I found out that they had sent my brother a pre approved credit card and he accepted it and used it. The credit card company had put me on the credit card too. with out my knowledge or permission. they have refused to remove me or send me whatever document they used as authorazation to open the account in my name.They required a social security number to be added to the checking account, but nowhere or no one ever said that by signing the signature card in someway authorized them to enter me into any contract or other business that could be done on my behalf by someone in the bank without my knowledge.

    I have been told unauthorized use of someones social security number to open accounts without their permission or knowledge is fraud. the credit card company will no longer talk to me and have requested any other business on this matter be done in writing. The manager at the bank the checking accounts were opened in has on 3 different occasions made the credit card company aware of the error but they refuse to correct it. Not only did they add me but they made me the primary on the account. I have had many cards in my life and have alot of credit all good, They have illegally used my name and social to enter me into a contract without my knowledge or approval and refuse to let me out, this is absolutely rediculious and criminal.

    because the card has a balance this has impacted my credit score , now my brothers getting alittle behind and they are going to send negative reports on my credit file on this account.

    I have a CD matured on July 11th. On july 11th, I added money to the matured CD and rolled over the CD to a new term. On July 15th, I called to transfer a partial money out of the CD into my checking account at Wochivia, the rep told me there would be a $54.00 dollar interest Penality, since I am within 7-day grace-period. I said OK. However, the next day, the transfer did not happen.

    Then I called again, this time , a new rep answered the call and she did not mention the transation fee. My understanding was no panelty as The amount in the CD plus the amount tranfer = total amount. I said OK to the transfer after confirming the CD amount Plus as the transfer amount=total amount. However, a few hours later, I found out $1386.00 was deducted as interest penalty.

    After multiple calls, Wachvia refuses to refund my money. They insisted that the info package was sent to me when I firstly opened the CD in February indicating the penalty although the rep did not give me the right info. However, I asked for the info which included in the package, no one sent it to me. Further, I asked for the definitonn of grace period, each person gave me a diff expalnation to show that I am not covverred within grace period. I asked for the definition in a written document, no one can show it to me.

    I tried to transfer $1,000 from my CD account into my credit card account (both BofA accounts), but the $1,000 payment never posted to my credit card. It is lost in space due to bank error. It occurred June 4, 2008. The case has been investigated by several bank reps, but no results yet. I call and call but I keep getting put off. What can I do and who can I call to get this resolved and get my $1,000 back? Thank you.

    BA routinely shows unauthorized withdrawals and misc random charges of unknown origin. Sometimes these are pending charges that never get posted, sometimes they do. 2 weeks ago was the worst; I had well over $300+ in multiple charges of unknown and unauthorized origin that put my account into a overdraft. The Overdraft was not real, only pending if/when the charges actually posted.

    In Multiple email inquiries BA said that I could not contest pending charges but wait until they posted, then complain and my account would be frozen pending investigation. The spurious overdraft blocked my access to my own money prior to an international trip. AND it also generated 2 separate $35 overdraft charges. The unathorized charges were never posted but the overdraft charges were and they stole $70 from me (this time) and are very rude and unhelpful when I try to complain about it. This is the latest example of a routine business practice by BA

    They are costing me on average not less that $100/month in charges, Fees, spurious random unauthorized charges

    As of July 14, 2008 I had a balance of $12.08 in my Wachovia Checking account. Later that evening I went to an ATM and deposited $60 in cash to cover a purchase I was about to make. When I checked my account balance from the ATM, it showed that my available balance DID in fact reflect that $60 deposit. I checked my account the next day and the deposit was not showing! There was however an overdraft charge of $70 (coming from a POSITIVE $12.08 balance). The deposit then posted and brought my balance to $2.08. The purchase that I had made the night before posted and once again overdrafted my account.

    When I called customer service to question these charges I was told that any deposits made after 4pm do not show until the next day. If this is the case, then shouldn't the ATM not show that deposit in my available balance? Also, even without the $60 deposit I should have had enought money in my account to cover the other 2 overdraft fees. I spoke with an account analyst (who was VERY rude) and was told that there was nothing that he could do about the $70 charge that was made, that he could only assist me with the most recent fee. After explaining my situation to him, he continued to insist that there was nothing he could do.

    After all the good press that Wachovia receives about being the #1 bank for customer service, and this is how I'm treated? You have GOT to be kidding me! I have never been so confused and furious at the same time. I will be going to the bank ASAP and closing my account with them!

    On the 14th I had some transactions posted on my account that showed pending and I was -$25+. My grandfather posted $200 cash in the bank at 11:30 AM. My account showed a $35 fee and $127 balance left. By 2:00 PM on the 14th my account reflected -$27. By the 16th with no other transaction, I am negative -$147. The details are as follow. The online transactions show I had a negative transaction of -$0.87 before posting. (how this changed, I have no idea) After various transactions showed as pending I had $127 left right before Noon. By 2:00 PM my account was -$27. Fees of $35 x 5 showed up and they still had transactions that had cleared show as pending. T

    he transactions show they tried to take money from savings which had $0 so to cover the -$0.87 and charged me $35 for trying to take it out and not having the money and then another $10 for the transaction fee. So, by the time the $200 was deposited I was negative -$10.87. Once money was deposited I guess they decided to take 5 x $35 fee, clearing a few transactions (all under $20) and now today, charging me over $300 total and my account balance being -$147 with still 6 transactions pending. I added up all my debit transactions and they don't even total $100 dollars.

    So, Bofa has ripped me off again. I am closing my account and leaving it negative. I really believe they have people monitoring and changing transactions because at every 2 hours of the day and/or by the next day, the transactions are completely different. I only make $9 an hour and work part time. Of course customer service tells me it's not a Bank Error. SInce when do you get charged fee's first, make you negative and then have all your transactions bounce and get charged more fees? Especially fees form the bank trying to transfer money from my savings when they can clearly see I had no money in it. This is fraud and I'm not sure how they are continuously able to get away with it.

    On 7/14 when my grandfather deposited the $200 I was stranded at work with a negative balance of -$25+. By the time I tried to withdraw (when I got a ride)I was -$27 and $200 had been used for the fees. My mother had to Western Union me some money. Today, after not having used my card because I was negative-$27 I am -$147+. That means the $100 my mom direct deposits into my accuont will go to fees and still they show transaction from 7/13 as pending so they can charge me more.

    I have been a Bank of America customer for years. I received the worst customer service from any business today in years from Bank of America. The agent named Elaine I talked to at 7.00pm kept inturpting me, was rude, sarcastic and racist. When I said I wanted to close my account due to this and wanted to talk to a manager, she refused. She said Oh, you only want to close your account because you did not like my answer, not because of the customer service.

    When I demanded I wanted to speak with a manager, she said if you want to, fine, but you have to be on hold for 30 minutes! When I called back and talked to Ron Redford and asked him to close my account and told him what happened, he did not offer any apologies either. He said he can close my account immediately and send me a check, but no manager will call me back after I close the account because I am no longer their customer. Worst customer service ever! I will make sure all my scheduled bills are paid, this is reported to the Consumer Affairs and then close my account.

    I too am a victim of Bank of America's NSF Fee program. I have been hit three times this year. Just this week I was hit with 5 NSF fees. I had a positive balance on 7/14/08. This included the pending transactions that were already deducted. The items fell off and as of today, 7/16/08 I am showing $210.00 of overdraft fees! I have spoke to representatives all three times as to why is the bank charging for transactions when funds were available but showed pending payment status. No one could come up with an accurate answer. I have been asked repeatedly if I have been educated in how to avoid overdraft fees. They only credited me back two overdraft fees this year and refused to credit me back in this weeks fees. They are simply horrendously wrong.

    I work two jobs in the effort to get out of debt and here is a bank who professes themself to be a peoples bank, who is putting countless of people in debt. I demanded for Bank of America to close my two accounts and they refuse. I am very concerned of what other fees they will try to apply while I am trying to gather the money to pay the current incorrect NSF fees that they have applied. I am totally disgusted with this institution.

    I had a mortgage with World Savings for 18 years, never a problem. Wachovia buys World Savings, problems right away. One month, I never received the statement. Payment is due on the first of the month. They sent out a late payment notice/statement towards the very end of the next month. Now, I had already called three times about this and they told me the notice was mailed out. I waited and waited.

    It took 11 days for me to receive the mailing. Now, let me tell you, the post office in San Antonio has to be staffed by snails. I hurried and mailed the double payment in on the 27th, the same day I received the statement. Two weeks later, I called to make sure the payment was recived and posted and I was assured it was.

    Today, the 15th, I received a NOTICE OF INTENT TO FORECLOSE. I called to find out what was going on. The CS rep told me my account was fine, it was up-to-date. I asked about the NOTICE I just received. She said that was mailed out on the 5th, the payment (that I mailed at the post office on the 27th) was not posted until the 7th (that is 11 days later). I asked her what took so long for the check to be posted, she said that's why they don't like dealing with the mail!!!!!!!!!!!!!!!! AND she said that the monthly statement is a COURTESY, that they don't have to send me one - I should know when my payment is due and make sure it's on time without any notice from them.

    So, now I'm thinking, HUH? I asked to speak to the manager. I was on hold for FIFTEEN MINTUES, of course, I could hear attitude in the manager's voice right off the bat. They charge a $10 or $15 fee for phone payments. I refuse to pay them that fee. I can't believe the dirty, underhanded manner in which they are trying to get this fee from me. I know I can't be the only one still mailing in a check for mortgage payments. I know I'm not paranoid, this is DEFINTELY intentional on their part. The CS reps are snotty about it too.

    They charged me a late fee. I have not checked yet, but if they dinged my credit, I will sue the pants off them.

    They have screwed me over so bad!! Ive been a GOOD bank of america customer since i was 16 years old & i am now 20! that's 4 years of GOOD customer service i never had any overdraft fees until march of this year when I was putting an order in for a customer of mine online and it went in twice! The company refused to do anything for me so i called bank of america and they told me they'd see what they could do! well now it's July and I now have more negative balances showing. I owe them -282 dollars from something that wasnt my fault! the transaction that went in twice was for 135 dollars so tell me again how that adds up to 282 dollars!

    I will never ever bank with them again! I don't have 282 dollars to throw way to the bank who refused to do anything for me. Also they charge you for using your account & Not using it seriously why would u charge me for not using my account? I will make sure i let everyone know not to bank with them! their over draft system is ridiculous!

    It was the holiday of the 4th of july i had eaten at a resturant on the 3rd of july and we went to wal mart afterwards got gas made 3 purchases. Over the holiday weekend we made a total of 15 purchases. Monday on my way to work i stopped at ingles to buy diapers for my daughter and later that evening around 7 got gas. All of these transactions were debit card purchases which in my thoughts ment money is avaliable for them.

    monday night late really early tuesday morning i called around 1am to see my balance which said 175.00. Tuesday July 8 i go to grocery store and my card is declined i was confused drove straigt to branch and was informed a car payment which had not gone through last week had coem back through the bank bouned EVERYTHING i had purchased from thursday on to clear a car payment making me negative 600.00

    i am still unable to understand how in the world it is legeal to charge someone fees for things that had cleared. then they refuse to close account take my entire payroll ck to cover charges and i am still neg. there should be a limit on fees guarantee this wouldnt of happened and if there rule is so true whywas my car payment not paid first time i would think it is because there wasnt fees to gain

    I recently found that Bank of America has been making automatic deductions from my checking account at Community First Credit Union in Santa Rosa in the amount of $200 a month. I called my bank and asked where they were sending the money as I have nothing to do with Bank of America. They tried to find out from Bank of America but they would not tell my bank anything because they were not the customer.

    So I called and they could find no account with my Social Security number on it and not one with my husband's on it so we are not customers and they will not tell us anything. I spent the whole day talking to different people who said this to me and dealing with the other people who assured that it was the other bank's problem and I should deal with them. Run around from everyone. Bank of America has $2400 of my money and will not tell me where it is and how I can get it back.

    I went to the doctor today because my blood pressure is way too high because of this. I want my $2400 back and I want to know how they got my money in the first place.

    Upon looking at my son's account on July 8th, 2008, we noticed he was hit with 5 NSF fees, when only being in the negative for 3 purchases. Come to find out they say they have changed the rules on pending tranactions, which means, that if you have a transaction for example: on the 2nd and it is showing it is pending, and make a deposit on the 3rd before it hard posts, bringing your balance to a positive balance, you will still get hit with a $35.00 nsf fee.

    He was in a positive balance on the 8th, 3 transaction hit his account, but he was still in a positive balance, but since they were from the 6th, and he was negative on the 6th he was hit with more nsf fees. They don't go by the balance of the day it hit, they go by the balance of the day of the transaction, even if the item falls off for a couple of days showing your in a positive balance and then reappears and your still in a positive balance you will still be charged. The notice states their rules have changed, but it does not state that they go by the balance of the date of the actual transaction and not by the current balance of the day the transaction actually hits. Is this legal?

    Was hit with over 300.00 in nsf fees, even though he was in a positive balance when the items hit.

    Bank of America has been automatically transferring $200/month from my checking account in Community First Credit Union to some account they have. I have tried to find out what this account is so that I can get my money back, but Bank of America says that they do not have a record of me or my husband having any account when they search by social security numbers. They then refuse to tell me where they have been sending the money.

    Both banks insist that it is the other bank's problem. Bank of America refuses to give my bank any information because they are not the customer and they refuse me any information because they do not have an account for me.

    Bank of America has $2,400 of mine and I want it back. There is also tons of emotional stress and upset and wasted time around the issue.

    Wachovia charges NSF fees based on an available balance and not the actual balance in one's account. I was mistakenly charged twice by a merchant (one charge actually cleared, the other was an authorization which was never posted on my actual account balance.) This double charge sent my account into overdraft. After the merchant corrected its error, Wachovia refused to refund the 2 NSF fees ($70.00 total) because it was not a result of bank error. They told me to get the merchant to reimburse me.

    I was charged $70 for something the Wachovia rep said wasn't my fault.

    I scheduled an online payment for $866.81 to my electric company. I spoke with my electric company they could not wait two day for the payment so I stop the online payment and paid them cash. The online payment still was process but return due to insuffient funds. I reponded to the via email and telehone call. After nine diffrent people, 10+ diffrent emails they claim the can not fund a process payment.

    How can a stopped payment, then NFS three times then emails telephone calls which transfer you to the wrong departments still gets processed after you deposited money in your account 10 days later. I have written check against that money which now bank of america is not processing including the rent. This is not the first time I have had problems like this with them.

    My wife and I have a checking (and two savings) account at Wachovia. One night, I went to the ATM to withdraw 140USD from the ATM and, while I looked away, the ATM 'ate' the money. As such, I withdrew another 140 thinking I would just call the bank and get it credited to the account in the morning. I called the local bank that morning and they assured me the money would be in the account within 7 days. About a week later, not thinking to question their assurances, my wife wrote a check for 105 for the lawn man. Of course, they never put the money back into the account and promptly proceeded to charge us over 400USD in NSF and overdraft fees.

    I called once I figured out what was going on and the bank did, after yelling long enough, reinstate all the fees and the original 140USD. That said, they did not change their system to reflect that our account HAD NOT been in a negative status for those two weeks. A few weeks later, my wife had appx 10000 deposited into our account drawn on a PAYNE WEBER account... the same account she gets appx 10000 deposited to her in that account every month of her life... as it is held in trust for her. Being totally broke and badly needing the money, my wife walked into to sort it all out and make sure we could have access to our money. They told her that they had to hold the money for a 14 days, until 7/08/08 because our account had been negative for so many days and they had to verify the check. AGAIN... they get the same check every month, and our account as seen over 200,000 in deposits from Payne this year ALONE. After all was said and done, they would not release any money.

    A week later, another 5,000 deposit was made, followed by ANOTHER 5000 deposit a few hours later that same day at the branch... wire transfer from our Payne account in Virginia. Now, that makes a total of 20,000USD we deposited in the bank within a week! The branch manage assured her she would have access to at least 5000. That night, July 3, we used the bank card for about a 100USD for gas and such. This morning, I wake up, ready to buy food and related items for a bbq for the holiday and come to find, the available balance for only 14 bucks. Imagine that... 20,000 in deposits (all good and verified...).

    Apparently, from what they told us, someone at the processing center put a hold on the money again... and nothing could be done for us. Now, just think about it, we have 20000USD sitting in an account... are absolutely broke... and they wont let us use our money!

    I use BillPay and set-up each payment as needed. Last month, I payed our car insurance earlier than usual because I was juggling some bills so I would have money available for the 4 July Holiday. Last month, June, I had ordered payments on the 27th to 4 of 5 accounts I have set-up in BillPay, the 5th being the insurance that I was returning to my regular payment for July.

    I checked my account balance today and found that Wachovia had made a payment to my insurance agent on their own and had billed me a NSF of $35. Now I have had to cancel our Holiday trip to SC to meet with fellow club members and I'm in the red with the bank. Is no one doing anything about this bank and their playing fast and loose with overdraft fees? Where can I go to report this and get some action from the Government?

    I've incurred a negitive balance, an unwarranted NSF, and have had to cancel a holiday trip with my wife because the little bit of money that should of been in my account was to cover a portion of our gasoline expense on the trip.

    I have been charged overdraft banking fees to my checking account numerous times in error. The bank has acknowledged it's mistakes but only credits me $68.00 and keep the hundreds of other dollars. My deposit dates keep getting changed, which is fraudulent which is purposely allowing the bank to make money off of me through $35 fees.

    Unable to pay my mortgage, unable to buy diapers and food for my disabled boys, unable to pay for their speech, occupational and physical therapy. May lose home now that the bank has taken almost $1,000 of my money. There needs to be an investigation of this company.I made a huge mistake putting my trust and money at this financial institution.

    I spoke with customer service representive about the fee they are charging me and they said they could not do anything for me due to the bankcruptsy file. Also, when I spoke with the supervisor over the phone about the problem that I was having , she said that I have to pay all the overdrawn fees no matter what the situation was. I have been a custumer since 1992 and It seems to me that they don't care they need to rip people off no matter what.

    I deposited a Federal Stimulus check into the ATM between Patterson and Turnpike with the amount of $600 on Monday June 30,2008, at approximately 2:15. I did not know when the cutoff date to collect these deposit envelopes was: 1:00 p.m. which is unusual because a normal ATM usually collects at 5:00p.m.

    This resulted in Bank of America to withhold my check when funds were due to go through and pretty much said when I called the 1-800 number that night, that I only had certain funds available. If I did know this, I would not have ended up making the necessary financial decisions that I needed to do, seeing as though I figured there would not be a hold on a government issued stimulus check.

    This resulted in having 4 overdraft fees of $35 a piece. I believe this is ridiculous for this bank to charge fees whenever they can. I work very hard for my money and not for the bank to charge $35 for every charge at will.

    Just like most of the peolple who have been taken advantage of due to NSF, my account was hit by a huge amount which was so big to even explain, i spoke to many bank reps who could hardly explain to me what happened, anyway i went to set a payment plan so the bank could get money from my savings every Saturday to cover for the balance,

    what they did after setting me up, they went on and cleaned up my saving account which already had my rent money i ended up paying for late fees on my rent. HOW CAN A BANK U TRUST TO ASSIST U EVEN AFTER U MAKE EFFORTS TO PAY STAB U IN THE BACK?

    Both my personal checking and business checking accounts were closed without any notice or any explanation. The only contact number was provided is 1-xxxxxxx. This is NOT an active number, as noone eve3r answers it (even during their own stated business hours), and noone has returned any of my messages. I had the local branch supervisor look into this, and they could not get an answer either.

    Other than the headaches of dealing with this, $5000+ of our cash (rent money) is no longer available to us. The letter stated that the funds will be sent out to me via mail. No time frame was given. Rent check and utility bill checks were bounced because of this (even though we had deposited cash into the account). This is absolutely ridiculous. One of the biggest banks in the county is run like a scam!

    We got slapped with $420 in NSF fees all the while our account NEVER went into the negative status. All because Wachovia subtracts pending activity from your actual balance before processing actual charges therefore resulting in a overdraft situation even though the balance at the end of the day is still in the black. And how about the policy of processing the largest debit first? Resulting in multiple small charges being returned and getting the NSF fee. Amazing how they can legally steal our money.

    No results really as of yet. Called customer service this morning and all they were able to refund was $105. I've left a message for the Regional Manager after the Branch manager told me that was the max they are allowed to refund a customer for NSF fees in a year. Also left a complaint on the BBB website, emailed 94 of my contacts and sent the info over to the 3 major local news stations for their public defenders/investigators to check into as well.

    On or about 6/18/08 I requested online to have a CD account of mine closed and a check be mailed to me. I was told on line that I would have to call in on 6/20. I Did! I was told the account was closed and a check would be mailed to me . On 06/25/08, not having received the check, I called in again. I was told the check was mailed out on 06/20/08 and I should wait 8 to 10 days because the post office is not reliable.

    On 06/28/08, not having received a check, I called in again. A person named David said the account was closed on 6/20/08 but could not tell when the check was mailed out. He was to call me 06/30/08 and let me know when the check was mailed. I asked him to leave a message if I was not there. He called when I was not home, but left no message.

    Today, (06/30) I received the check and I find that the check was not made out until 6/26 and was mailed out on 06/27. This was an account that held $59,752.56 I want interest for 06/20/08 to 06/27/08. Loss of interest from when the account was closed and when they made out the check was about $44. I purchased other CDs today . Not at Wachovia (never at Wachovia)

    They assess fees in the form of overdraft and my family has been victimized enough, to say in these days of economic uncertainty.

    For inquiring to waive the excess fees (couple of thousand dollars), we were asked to close the account and eventually we did. We feel this Bank and several others like BOA neither has conscience, corporate responsibility and least any compassion.

    I had World Savings checking account and a home mortgage loan with some problems before Wachovia took over in 10/07. We had direct deposit for my husbands paycheck which always posted between 1:00 and 4:00 am and credited that day. Wachovia would show the credit but everytime you purchased gas they would put a $100 hold on your account for 5 days we both purchased gas 5 times in one week so the bank held $500 and bounced our checks and other atm purchases at $30 a pop.

    We were not overdrawn because of what we bought but we were overdrawn from the holds on our account which then showed us as being in the negative. We could not stop the direct deposits because we showed as being overdrawn because they bounced our house payment not due to lack of money but because of their holds on gas atms at the pumps. The bank told us the gas stations put the holds on our account this was a flat out lie.

    When I kept contesting these charges they would credit me the fees and then recharge me the next day plus charge me another $30 fee for continuing being nsf. I made a house payment in cash so it would not be late or bounced or charged extra fees on a friday before they closed at 6 with a receipt dated that day and they still charged me a late fee because the banks main headquarters is in a different time zone.

    My complaints to the bank has gone no where. It took 2 months of this abuse from Wachovia before we could finally have our direct deposit go to another bank. They charged us over $1200 in bank fees, late fees and nsf in 10 weeks. We are still running one month behind on our home loan which has totally wrecked our credit rating so we can't refinance to move our loan to a different lender. I called their home location and asked for a copy of fees they charge concerning holding back extra money from your checking account when using my atm card, and was told by 3 different bank employees that the notice is posted in every single Wachovia bank. I went to three different branches and not one of Wachovia banks has it posted or where you can find a fee schedule for this fee.

    In other words this fee is not listed or posted at any bank or web site. I still have my free checking account with a balance of $13.00, and maybe I will make a deposit of .25 cents in the next month or perhaps a withdraw of .10 cents. I plan to do this until the day I die, deposit and withdraw .90 cents a year.

    The economic damage has put us so far behind on bills we owe and damaged our credit rating from high 600's to a low 4 to 500. I have not been able to pay any credit cards, have borrowed and owe money to our family and friends cannot write checks anywhere that uses Global or telecheck for approval and we have only been able to make interest only payments on our house, the list keeps going on and on.

    This Wachovia nightmare has cost us in the final accounting much more than money, it has cost us self respect, our retirement for at least the next 5 years. With the prospect of paying high interest on anything we purchase for many years to come.

    Monday, June 30, 2008 Bank Of America So here's where the frustration begins. I have a family, Two Kids wife dog house etc... The children are of a age where mom stays home to take care of them and we have a limited income. We had a previous account at citicenz bank and just never got around to closing it. Apparently this account was over-withdrawn by a about $1.20 and reported to Chex Systems where Bank Of America took this information from the banking reporting company and froze our account. Under normal circumstances, this wouldn't be a problem. we found out about this at Friday 8pm EST. The office that froze the account is open mon-fri 8-4. Fine, we will go the weekend without access to cash, Kids dont need food or diapers right?

    Monday morning comes, I call BOA at 8:15 to resolve the issue. I was on hold until 9:45 until I hung up the phone and decided to go to the bank in person. I went to the bank where they in turn actually called the same number that I did and said I had to call Chexsystems to resolve the issue. I used the phone at the bank and called chexsystems. They told me i had to file a request for the report and it would take 5-7 business days for the report to come through the mail. I STILL HAVE NO MONEY... and the account balance is about $4500.00

    So at this point the only thing i could think of is that Citicenz bank had somthing to do with this, because i still have NO information from Bank of america. Did I mention that my paycheck was directly deposited into the bank this morning. Insisting that bank of america release my funds, and they didn't. Finally I came home and called bank of america. They at least told me that the report was from Citicenz bank and a check from BOA will be mailed to us on the 15th of july. GREAT- So how do I go about my daily life until the 15th?

    i was wrongly overdrafted four (4) times through this bank. first overdraft i received was for a savings account i requested to have closed & it said on my online statement 6/26/08 insufficient funds in savings, then to be changed to overdraft item fee in which they pulled up a charge to make it seem as if i actually overdrafted & changed the date on that charge that i payed for it.

    i'm fairly certain that no matter how long it is in the pending process they cannot change the date it was made on. the last three were just outrageous & they pulled up charges the same way. i will be stopping into the bank to show them proof that i placed those charges on different days in hopes to get my money back.

    i lost $185.00 through their shady dealings, & subsequently cannot pay for my medications for a herniated disc in my back & for general needs. i make minimum wage, work three days a week, & they are robbing me of all my money.

    I had 10 overdraft charges in 3 days. Everytime I talked to a cust. serv. rep. I would get a different story. If one was to look at my bank statement you could clearly see there were some errors made because my deposits were not showing up and the only thing that was showing was my card transactions as if were done purposely so I would get charged.

    I also had a situation where made a cash deposit at the atm and the atm malfunctioned. I called customer service and they made a credit to my account and after the so called investigation they took the money back. I made several attempt to make my case but I constantly got the run around. I asked for security video to show that I made the deposit but no one wanted to help. Basically they were saying it was just my lost..too bad.

    With now two separate credit cards (accounts) on consecutive occasions, Bank of America has sent out the statements so that by the time that I receive the statement I have a week to get it back to them or pay interest. This is clearly an attempt by Bank of America to: 1 - Charge interest to people who pay their balances on time, every time. 2 - Move their customers to pay immediately via electronic payment or 3 - Move their customers from credit to debit cards.

    In any respect, I find this practice unconscionable and outside the bounds of the credit card agreement executed between the consumer and Bank of America. I am put in position to pay usury interest rates on a credit card on which I pay the entire balance via US mail within 24 hours of my receipt of their statement.

    Another debits before credits story. I made a deposit at the local Wachovia branch before 1:00pm and the next day my deposit showed on my account...followed by a NSF fee for a check amount that was less than the amount of the deposit.

    I cashed my paycheck at Wachovia which was

    written on a Wachovia account. The check was for $1460.00, and the teller handed me back $1455.00. When I asked where the other $5.00 was, she said that there was a charge for cashing the check. I feel that this is stealing. When I expected the check as full payment I did not agree to pay $5.00 to cash it. Had this been a check for $5.00, it would have been worthless.

    I can't get my money out.

    I never chose to be a Wachovia customer. My previous employer did that for me when they transfered our 401K accounts to these slime balls.

    When I changed employers, I wanted to roll my money over to an existing IRA at another institution.

    The first challenge was locating the correct Wachovia office to handle the request. Customer Service couldn't help me. I had to talk to the Distribution office, which has limited hours, weekdays, office hours, eastern time.


    So I waited until that office was open again, called in, requested the roll over. They refused, telling me the account could only be closed via a "distribution" directly to me with a check made out in the other institution's exact legal name. Did I have the exact legal name of the institution? I was told that if the check was made out to anything other than the exact legal name of the institution, per the other institution's instructions, the check would be rejected.

    So I contacted the other institution, which provided the magic name, but not before the Distribution Office had closed.

    So I waited until that office was open again, called in, requested the distribution. This was 2 June.

    Waited a week. Nothing happened. Waited a couple more days. Nothing.

    Called in during the tiny office hours. The check had been mailed 6 June, they said. This was 18 June. I was advised that no action could be taken until 10 business days had passed since the issuance of the check. The way they count business days, that meant 24 June.

    At that point, if I still had not received the check, I could request that payment on that check be cancelled and another check issued. So, the 24th comes. I request the stop payment and the new check.

    I'm told I have to fax or mail a "Lost Check Acknowledgment and Repayment Agreement" on the check that was issued 9 June (three days after it was mailed).

    25 June, they fax me the form. It has to be signed and notarized. Then you can fax it back, but if the seal isn't legible, they can reject it. Or you can mail it in.

    There are a few problems with this scenario: In five plus years at my current address, I have exactly one (1) delivery problem, and that was with United Parcel Service, not the U. S. Postal Service. So it's unlikely a check was ever cut, much less "lost in the mail." The notarization requirement protects no-one from anything, but it does let Wachovia continue to hold the money without having to pay interest on it for another two weeks. Or more.

    My wife deposited a $500 payroll check into our joint checking account on 6/23/2008 by handing the check to the teller at a local Wachovia branch. She asked the teller when the funds would be available prior to making the deposit to confirm that the money would be available to us in a satisfactory time frame. The teller informed my wife that the funds would be available in our account on 6/24/2008, which is the following business day. On the deposit slip provided to her at that time, it clearly shows in black and white ink that the deposit effective date is 6/24/2008.

    First thing this morning, 6/24/2008, I checked our account online to verify the funds were available as expected. To my dismay, not only was there no indication of a deposit ever being made, but my account is now overdrawn incurring $44 in unavailable funds fees. The check that I had deposited the previous day should have been available, which would have prevented this overdraft from occurring. I called Wachovia and explained the situation. I was informed by the phone representative that she agrees with me, and I should get refunded the full amount. She then transferred me to another representative.

    The new phone representative informed me that she sees no record of my deposit, and it should show up at 12:00 AM on 6/25/2008. I informed her that my deposit slip indicates that the funds should be available today, not tomorrow. I was then placed on hold, so that she could contact the local branch for verification. I was informed that the branch manager could not find any record of my deposit, and could not remove my overdraft record or refund the fees incurred. It sounded to me that I was being told by my trusted financial institution that my deposit had disappeared, and may turn up the next day. The phone representative then became very defensive, and insulted me by telling me that I charged too much on my card, and then made a deposit to try and fix it.

    I did not spend more than I had; the bank just screwed me over. I told the phone rep that if the funds are not available until after midnight, then it would be the 25th, not the 24th as I have been informed and have in writing. She then told me that I am entitled to my opinion. OPINION? That is a statement of fact! I can't believe the hassle I am having to deal with. I have been a Wachovia customer for over 3 years. I have never been overdrawn, and my account has been in good standing since day 1. I use direct deposit (for me, wife receives a paper check), and I have never made a complaint before today or requested a refund for any fees. I can't believe the bank won't support me in any way after trusting them with my finances for years in good standing.

    I plan to refinance my house this summer. With lenders already tightening up, what kind of interest rate am I going to get with a recent overdraft on my bank account? This is not acceptable. This is not the first time I have been unhappy with Wachovia, but it is my first complaint. Now that I no longer trust Wachovia, I have to go through the hassle of opening a new account with a different bank and notifying all my direct debits of the new information. My direct deposit will take a couple of pay periods to update. I am extremely dissatisfied with Wachovia and will make sure as many people know about this as possible for their own protection.

    I was deceived by my bank, charged fees as a direct result of this fraud, and then doomed to higher interest rates because of the overdraft record in an already faltering economy.

    The bank put holds on several items, that they charged NSF fees for, then charged overdraft fees. Online and on my print out, there was sufficient money in the account, the first two times, therefore, there should have only been one of the overdraft charges.

    When I went to the bank with my online banking print out to ask why they took money when there was enough to cover the items, she said that they had added up the items while they were being held and charged a NSF and then when they actually came out, they charged overdraft fees! I was charged tripple fees because they took money out for the same thing 3 times, at $70.00 for two, and $105.00. The lady offered no customer service, she just stated that is what they do. I closed my account.

    I deposited a check into Wachovia's ATM for $600. I called their 800# to make sure I received the $100 courtesy allowance, the balance was $103 per the automated system. I went to two grocery stores and spent $44 and $38. The next day, I received 3 OVERDRAFTS in the amount of $105. I called furious, they said that money is only available for cash withdrawals not debits. WHAT? The overdraft charges were for 3-$3-$4.00 debit charges that had already cleared two days ago. Please someone help me to understand this?

    They will only refund 10% of the $105. I told them that I am not accepting this deal and that they are in the wrong. Actually almost fraudalent! How can they switch my transactions to make it seem that I am in the negative. What kind of game is this? In the last few months, Wachovia has been backing out my deposits for a day and applying debits first. Even though the online service that day says the money is available, next day it's processing. How can they get away with this?

    Consequences...I have lost at least $35.00-$105.00 a month to Wachovia and their 3-card Monty bank services. As a Realtor within a slumping housing market, I need every dime I have!

    I feel that it's one of the worst banks you could possibly do business with. I've been a customer with them for 5 years, and they recently charged me over $700 in overdraft fees in one day. Apparently I had pending transactions that went though which over-drafted my account. On the day this happened, I was using my debit card all day in the subway ($2 a pop) with no knowledge I was over-drafted, and they were letting the transactions go through. They charged ($35) every time I used the card, which at the end of the day, for about 40$ in transactions, they charged me over $700 in overdraft fees.

    I had plenty of money in my savings account and credit card to cover the overdrafts, but they made no effort to cover me, or alert me that I was over-drafting. When I called to ask about at least getting some of it refunded, they treated me like sh*t and said there was nothing they could do. Now, $700 isn't a crazy amount of money, but the fact of the matter is, they're scam artists. What other company do you know of that is allowed to charge roughly 170.5% interest on borrowing money ($700 they charged % $40 I borrowed.) There are laws against this kind of thing, but apparently there is no law governing how much a bank can charge in overdraft fees.

    I feel as though there should be more laws written on banking practices. I take the blame for not balancing my checkbook as well as I should have, but I'm outraged at the penalties banks charge people for this, it's a legal form of robbery. It seems all I can do now is spread the word!

    Wasn't able to pay half my rent this month, had to borrow money, at interest, putting me further in the red.

    They placed a 2 week hold on a payroll check that I deposited by ATM. I have direct deposit, from the same company, that goes into my account every other week. This specific check was a bonus and without mentioning the hold by email or mail or phone, the bank placed a hold from 6/16/08-7/2/2008. I thought that I had money, and used my debit card for $1.61 coffee's and $2.00 parking fees.

    In addition, I have written checks and made payments online and almost everything has been returned or will be returned. I have tried to contact the bank by phone and email, no one is willing to explain why this has happened. To make matters worse, the fees they are charging me are $35.00 each, plus all the fees that the merchants have/are going to charge me.

    I already have over $460 in fees now! I am a single parent and I live in a very expensive region of CA, I'm not even going to have gas to get to work or have food to eat. I am afraid that when I get paid on 6/27, they will eat up my entire pay check in fees!

    I have over draft protection on my checking account at their bank. How it works is when i overdraft it automatically charges my credit card $100 and it deposits into my checking so i never go negative. I went on vacation at the end of march to early april and I was using my debit card with no problem and no worries. I get back from vacation and deposit a $300 check into my account and I see that my account was $650 negative. This was a sunday night I had to get back to school that night.

    So the following weekend i went to the bank on a saturday, and spoke with Ed. He said yeah i don't know why you were charged, he called the main office and the person on the phone said I shouldn't of been charged either. Ed said i was going to get my money back and he would give me a call on monday. Ed never gave me a call. I went back into the back a couple of weeks later. The women I spoke with wouldn't even talk to me she said Ed would give me a call he never did again. I went to a different location to talk with a different representative. She could not give me any answers either and said she would call me. She never called me either.

    I went back to Ed. He said I payed a credit card payment late and that automatically unlinks the overdraft protection. I was never told that I didn't have protection anymore. I was never asked if I wanted to relink it after I payed. After my vacation I was left to live on my credit card. I had $350 in my savings and they took the money out of my savings and put it in my checking to pay off the balance with out me knowing it. This bank is wrong and cost me a lot of money and debt. Also if my account was over drawn why would it let me keep using it to rack up $650 that should not be allowed especially if i was unaware.

    I have had to live on my credit card while away at school. I lost $650 dollars, and suffered extreme embarrasment.

    i had a bofa checking account my daughter stole some of my checks and preceeded to write out and cash them i paid off the checks as they came in i cntacted bofa and told them and ask them to close out the account from nov of 07 and up through april of 2008 they would still allowing hte checks to come thru so they could charge overdrafts fees, and they didnt close out the account till 01/08

    they now have me in same claims court for overdrafts fees in the amount of 1945.03 even tho i had called them over and over and ask them why they were charging me overdrafts fees on stolen checks and why they were allowing those checks to run thru 3,4, and 5 times each. every csr i talked to could not give me a reason why all they would ever say it is your account and you are liable for it even tho i had ask months beofre to have it closed out and reported the checks as stolen, they would not and had not recorded the checking account as stolen

    now i will have to pay all those charges plus maybe criminal charges due to their neglengence

    I recently moved to Salt Lake City, UT where Bank of America does not have a physical bank location. Since my checks get direct deposited anyway, I chose to keep my BoA account open but for the few occasions I have a paper deposit, I have to mail it in. I fedexed a deposit and waited for it to show up in my account. It showed up as pending and I used my debit card. However, the still showed as pending the next day but my charges cleared.

    Since I made the assumption the pending deposit would clear, I won't beef about it being held longer. HOWEVER, even without the deposit, I still had $47 + change in my account. My debit card charges were $29 + change and $20 + change respectively. Only ONE of those charges would have caused an overdraft but they charged me $70 in OD fees for both?

    The CSR told me that they sent out an account update in December stating the change in the fees policy. Now they will charge fees for all debits they process the same day if the account goes into the negative. I asked the CRS you mean, even if one of the charges doesn't cause the account to go negative, I get a fee because both charges were processed the same day? She said yes. HUH?

    Fees!!! FEES!!!!!

    my son had a account, me and my husband have an account also, my son who is in the us navy, had some issues and over drawn his account . we have told wachovia several times that my son was out to sea and they needed to send his overdraft notice to him, gave address and number to the bank. but they never contacted him about his account.

    what they did was went into my account and emptied it of 686.56, to cover my sons account. no notice to me i find out when i go to pay my bills and find i have no money in my account. first i call cust service and questioned. they say nothing we can do and hang up on me. i then go to the branch office in middle river md, to be told thats our policy and if you dont leave we will call the police to remove you.

    i then call back the 1800 number to then be told very rudely that we are not getting our money back because thats our policy, thats my sons account, my own personal account has nothing to do with my sons overdraft.its totally wrong that the bank can just transfer money from peoples accounts to pay other peoples bills. without any notice at all. i asked the rep if they were gonna pay my bills and overdraft fee due to they stealing my money she says that i need to call the companies i owe money to to make other payment arangements because they will not give me my money back

    A hot shot salesman in Florida called my wife and stated that he was now our Wachovia contact and he had a deal that would pay us 8% per year. My wife said that is too good to be true, send us information. After he hung up, he sold our Government Bonds that were maturing with out our permission and bought Wachovia 5 Year special C.D.'s. I could not believe he could do this and contacted our local rep. He said, since this guy may come up on charges, he could no longer represent us because Wachovia would fire him if he was involved. I went through Wachovia, who gave us a long line of stall and basically said they could do nothing.. This conversion cost us thousands of dollars so far and the CD has not matured yet. Almost $200,000.00

    I've lost nearly $400 this year to the same sorts of Overdraft/NSF charges that these other folks are complaining about. The online banking isn't worth the webspace if the balance available isn't really available. Five times I've been charged twice for an item...a charge would be listed in the Check Card Hold area, and any items moving to the transaction area of my account that night would be charged the OD/NSF charge, and so would that item that would remain in the Hold area. The next day, unless I hurried, begged, and borrowed enough money and got to the bank in time, the item that was coming out of the hold area would be charged AGAIN(!!!) when it was moved to my transaction area.

    Add insult to injury, just today, I see Wachovia has added a Deposit Holds area to their online banking. How insulting! I've been a customer for 30 years. For my JuneYear's Resolution, I've opened an account with a competitor, and will completely be out of Wachovia within 30 days.

    Like many others, I live paycheck to paycheck, and that $400 hurt deeply, putting me behind with several of my regular creditors.

    We have been a long time commercial customer of Bank Of America. We utilize our debit/checkcard to provide payment to our vendors daily for work that they do for us. There can be as many as 20 transactions in a day authorized by our vendors to our card. During the day and evening the transaction will be sitting as 'pending' in the online bank statement we can review. Often Bank Of America will allow the bank account balance to go into the red for pending transactions. Normally we will transfer funds to cover these pending which automatically removes them from the red or negative status prior to posting with a date.

    Occasionally, during the month we may miss doing this by 12 midnight and a pending goes to posted with a date. This would show up as a 'red' negative to the account in the dated transaction section. We are in agreement with the bank that once the pending goes to a dated red negative it is an overdraft. In the month of May, on one day, 10 of these pendings went to red negative dated. Therefore we expected a $350.00 overdraft fee for this error, as has happened in the past. We agree it was an oversite. We have never been charged overdraft fees for pending items that did not move to the section with a date. As long as we cover the pending before they moved to an item with a date we were fine. For two years we worked under this premise and were charge minor monthly fees for a small amount of overdrafts that slipt by.

    Today we were debited $3300.00 in overdraft fees which were ACHed out of our operating account without notification prior. Of course it put our account in the negative which we had to cover to avoid problems. Our Accouting/Office Manager reviewed the transaction in May and could only locate the 10 overdraft items we anticipated on the statement. All other pending items that appeared negative were covered before the posted with a date. Bank Of America is now claiming that they consider there to be 90 overdraft items for the month! Although we only see 10.

    We spoke with our bank assistant Shasha out of Point Pleasant, NJ. She indicated that she could prove 90 overdrafts and would fax over verification immediately. She has not done so as of yet. We tried to explain to her that we have not changed the way we cover our pending transactions and that we only saw 10 overdrafts. She rudely insisted we were wrong, and that their banking practices and rules had not recently changed, although it appears that they are now charging us $35.00 for 'pending' transaction that go in the red even if we cover them before they date.

    We have just been charged 10 times the normal fee we would expect. We are at a loss as to how to handle this situation. We feel that Bank Of America played it underhanded by changing the overdraft rules mid-year to get funds and fees from our account on transactions we never were charged on for two years. Just when we feel that we have learned the rules of Bank Of America they change them to invoke more fees.

    Our corporation lost over $3000 in revenue because of Bank Of America's trickery, and stand to lose another $3000 next month because we no longer have a handle on their rules and the games they play. If they can not prove 90 valid overdraft transactions according to the rules we have abided by for over two years, I am considering contacting my corporate attorney.

    pulled $564.05 from my checking account and can not explain why they pulled that money . I closed the account.

    I recieve a letter from collection agency for $218.40 for fees associated with not using the account and having a negative balance from the time they pulled the money from my account.

    A Wachovia employee called me and asked if there was anything she could do for my business checking and savings. It was crystal clear that she wanted to SELL me something, not ASSIST me with anything. After speaking with her for a few minutes, I told her she could help me with ordering a box of checks. I have never in my life paid for checks and had no idea she planned to charge me for checks.

    I found out later that Wachovia has a new no fees business checking account, but she never mentioned this to me, nor has ANY Wachovia employee mentioned it to me despite seeing me in person at least once a week. I got the checks and found out she sucked $21.00 out of my account without notification nor permission. If I had known there was a charge, I wouldn't have told her to order checks. Like I said, I've never paid for checks in my life. Why would I start now? Basically they lied by not informing me of any charges for checks.

    Lost $21.00 through dishonesty as far as I'm concerned, but I have also spent many hours trying to deal with the customer service people at Wachovia.

    July 2007 I made a online purchase using my Wachovia check card for the amount of $133.00. After not recieving the items I bought I contacted wachovia and filed a chargeback for the said amount. The money was put back into my account only to be taken out a week later again. I stopped using the account and contacted wachovia again to see why they said I needed to file a hard copy with disputes dept. so I did instead of mailing it in I got there fax no. and faxed it in.

    I contacted wachovia for the third time only to be told it was too late. At this time I had a 6 or 8 dollar bal. in the account and told them to close the account. I was so [upset] I just threw my checks and cards in the trash, only to find out later they neglected to close the account and someone was trying use checks for all kinds of stuff, dept. stores and even tried to pay a motgage with a check # I didn't even order yet. They never paid any of the checks but with the nsf fees pileing up wachovia finally closes the account and turns it to a collection agent.

    Now not only am I responsible for the checks wrote but wachovia wants all the nsf fees collected and is ruining my credit with the collections depts.on it just because a wachovia employee neglected to close my account when I requested them too

    One Fri before going out of town a few years ago I deposited a check in the ATM near my home @ local branch which was closed for the day, got my receipt with my balance & went in my merry way. I went out of town & attempted to get cash but to my surprise on Sat night, I was in the negative! I called customer service & he explained even though my receipt said 1 thing it wasn't my true balance because I missed the cut off time. Made no sense 2 me but I also explained 2 him I was hitting the credit button so the charges hadn't even posted, but he said that didn't matter. @ that time the guy agreed to waive 1 of the 9 or so fees, I was upset & didn't want to argue about it with everyone around & figured I would call back later.

    Ha, guess the jokes on me because the reps kept telling me since I agreed to one fee that's all I was getting like I was bound in a legal contract. So now of course I am n chex systems for boo-koo $ that I still can't understand how I owed it when the $ was already deposited. Oh did I mention I was a signer on my moms account & wachovia messed her up 2 so she didn't pay & they took the $ out of my checking account! UNBENOUNCED TO ME! I can't stand WACHOVIA & their shady practices.

    I am currently in check sytems & cannot change my checking account # with my credit union because the process req closing & opening a new checking account. Fortunately no one found those books of checks I lost

    I had a bad day today. I recently opened up a new account at the Bank of America. I opened it on April 29th this year. And so everything was going well...I made a small mistake with my address since I am new to Miami I wasnt sure whether I live at 70th or 71st street...but it was 70th street...so I changed that like 2-3 weeks after i opened the new account. And the rep said that I would recieve my card within 10 days...nothing happened, but I was patient I waited for a little longer and just yesterday I went and spoke with them personally and everything seemed fine...they gave me a temporary card and I also deposited the cheque my friend gave (he owed me 1645.50 ) as well which was the only deposit in my bank as well...

    The next day I tried to use the card and it said denied so I went back to the bank and they ACCUSED ME OF FORGING my friends signiture...so my friend was waiting for me and we both went to the customer service agent and we discussed the matter and still they wanted us to fax in a notarized letter by his bank and also his ID. They couldnt even explain why I was accused of that...and my friend said that he just wrote some cheques for something else and it was processed without a problem.

    So next we went to his bank (Washington mutual or something like that) and his rep even told us that what they are doing is ridiculous and that Washington Mutual never put a hold on the cheque or anything like that. So then I called Bank of America Customer Relations and they told me in a very very rude manner that my account is closed and that I would recieve the money in my account from them as a cheque to my place without any explanation of why i was being accused of forgery. I cant believe this has happened and I cant believe that I am being alienated and treated like a piece of garbage by these ppl and I didnt even do anything wrong. I am very upset.

    I have recently had some very troubling issues with Wachovia Bank. In short i have been charged $595.00 in a week for 17 non sufficient funds/over draft fees. My wife went to one of our local branches and asked for their copy of our transaction record. I reviewed the transaction record given to us by them and parsed it line by line with a calculator. only eight of the original 17 nsf/ od's are valid. The rest are either two of the same fees assessed to one transaction or they are assessed before any actual payment is made or overdraft incurred. Each fee is $35.00 and the total of the nine that are wrong equals $315.00.

    I have since gone back to my local branch and discussed the problem with a customer service representative. They told me there was nothing that they could do and that Wachovia banking policies were clear and had not changed. Should Wachovia, with the BBB's urging, right the wrong and refund 9 of the 17 nsf/od's there are still 8 nsf/ofd's to the tune of $280.00 for a total of $85.00 in over drafted funds. This is an appalling abuse of services to the consumer and needs to be stopped. I have researched the issue further on line and found that there is no small amount of abusive banking practices leading to the success of Wachovia and it's enterprises. I am very interested in finding out what can be done about these policies at a legal level.

    Overdrawn almost $450 and have no funds available until next pay period unless I continue to overdraft my account

    Opened an accout online as we were moving from Oregon to Michigan and had to switch to a bank that was local. They told us LaSalle Bank, Midwest had been bought out by BofA and that in May, it would be a full working BofA branch. It's not! Since we had opened an account online, it took us 3 weeks just to figure out what our routing number was and that was with BofA's assistance.

    We had requested documents from the Customer Service phone people and here we sit, three and a half weeks later waiting for them. Just had Kitty from BofA customer solutions call and ask us if we still needed them (duh, yes) and asked her if they could expidete them since we had been waiting for all this time and she told us that it would cost US $15 to fedex them. She was very rude and discourteous and didn't care what the situation was.

    I reported a check fraud on my checking account on Jun 10. The bank helped with getting my money back and said that if I would like to put a security hold on my account then I can call back and do this. I did call back and asked that they do the security hold, they put the hold on my debit card. 2 days later the same check fraud came through taking more money from my account, and caused anover draft.

    I called the bank but they said they would not help me becasuse I did not put the security hold on the account. I explained to them that I did put the hold on there, but the guy from there bank put it on my debit card instead of my checking account. They said that they would NOT help me, and I would have to pay the fraud check and 3 35.00 fess that they were putting on my account for the over drafts. I did what they told me. The guy at their bank screwed up and now I have to pay the price.

    I now have to pay the fraud people and the bank their fees.

    Four overdraft fees that should not have occurred. Our register and the on-line statement provided by BofA agreed. However; the statement that BofA uses (that we, the customer do not see as verified during a telephone conversation on Feb 13th) did not agree. Basically, BofA said we made a $44.33 mistake. When asked to show us the mistake they (Ms. Carpenter a supervisor at BofA) could not show the mistake. I told her I disputed the fees and wanted a refund. She said no, it was our mistake but could not or would not prove it to us.

    This has happened several times. I want everyone to know two things. 1. The on-line statement is not trustworthy unless it benefits BofA. 2. If this happens to you PLEASE FILE A COMPLAINT WITH THE OCC!(Office of the Comptroller) When I asked the BofA rep where I could file a complaint she suggested the in-house BofA complaint procedure and the BBB! When I asked her about the OCC she said she haad never heard of them!

    I am diabetic. As a result of this creative manipulation of our account I was unable to get my perscription filled so I am out of medicine tonight, tomorrow and well, until we get enough money to cover these incorrect overdraft fees and I am unable to purchase any groceries. I informed the BofA supervisor (Ms. Carpenter) of this but she didn't care.

    Wachovia Bank has a 2pm cutoff for cash deposits. That is to say if you deposit cash to your account after 2pm, it will not be posted to your account that same day. It will 'officially' show as 'processed' to your account the next day.

    Yesterday (6/10/08), I made a cash deposit to my account after this deadline. I then called the 800 number and talked to a representative named Carol A. I told her that I had made a deposit after the deadline and that I was afraid that since I did so, I might be incurring an overdraft fee for a charge that would most likely be debited from my account the following day (Wachovia charges $30 for each instance of overdraft). Carol assured me that since I had deposited cash, an overdraft fee would not be incurred for any charges that hit my account the next day. I want to be absolutely clear at this point and say that if Carol had told me at that time that since the deposit was past the cutoff time, I would be incurring an overdraft fee, I would have let it go. But, as stated above, Carol told me that I would not have a fee.

    The next day, there was $30 charged to my account for what amounted to be a $4 overdraft (which technically was covered by the cash I had deposited on the 10th). I called back and I was told by numerous representatives (most of whom seemed pointedly uninterested in the fact that someone who worked for Wachovia had told me that I wouldn't have an overdraft fee) that I was at fault and there was nothing they could do for me other than offer a courtesy refund of $4 which I finally accepted after what amounted to over an hour on the phone with them. One reprehensive named Antoinette M seemed utterly incapable of grasping the concept that I had been told by one of her co-workers that I would not have an overdraft fee. After explaining the situation to her no less than 3 times, she could only iterate that since I was at fault by depositing my cash past the deadline, Wachovia would not refund the full overdraft fee. She told me it was her company's policy for her to not give out her phone number and extension should I need to contact her again.

    I have an auto loan with Wachovia which I have had for well over 5 years. I have NEVER been late on this account. On May 28th, I paid my bill. On June 9th, I received a letter in the mail stating my payment to Wachovia was short by $70. I knew I would be 30 days late if the additional payment did not post to the account by the 15th of June, so I scheduled a payment from my Bank of America account to post on May 12th.

    In the meantime, WITHOUT authorization, Wachovia automatically deducted $70.04 from my checking account and THEN hit me with $70.00 worth of NSF fees. When I called Wachovia and explained they did not have a right to do that, the CS rep hung up on me. I was told the bank has a right to take funds out of your account if the account is deliquent by 25 days. I have NEVER signed anything in regards to this policy nor do I have anything in my loan papers regarding this policy.

    I feel violated and I have lost 2 hours of work trying to straighten this out.

    Bank of America set up a fee system that's just dirty. Used to be when your balance was at zero you'd be denied. I assumed that was the case. I moved my savings out of checkings and overdrew on my account. They charged me 25 to 35 per debit that i charged after I hit zero. It came out to about 300 dollars. 25 dollar fee every time i put a coffee on my debit on the way to work. It's criminal.

    My daughter has a Wachovia student checking account linked to mine. Last night I checked my balance on-line and saw that she had less than $100 avail-able balance, including 3 check card and no deposit holds. I transferred $132.68 into her account, which then showed a balance including the transfer I had just made. This morning, 3 other transactions popped in between yesterday's balance and the transfer, resulting in an overdraft.

    It appears that Wachovia intentionally posts debits before credits to maximize the chance of an overdraft, even if it negates a prior posted balance. From prior postings this seems to be common practice at Wachovia and, I think, should be investigated. It certainly is not customer-friendly.

    This action resulted in an unnecessary $35 charge after the deposit had already appeared as available funds. It is as though the deposit was backed out to allow the overdraft.

    Wachovia misleads you by letting you think you have enough in your account and actually giving you money from the ATM and then a day later you find out that you are overdrawn by a few pennies (23cents in my case) and they charge you $35 fee.

    Additionally, other items that were on hold will start to come in and they charge you $35 for each of those items regardless of amount. I didn't even know I had Non sufficient funds, becuase a charge was made by a restaurant that was not supposed to have hapened.

    I attempted to transfer money from my savings to my Wachovia checking. In reality I did the opposite (clicking error) and it cause quite a few overdraft fees. I immediately called and talked to John Rodel at extension 83742 and gave him the run down. He reviewed my account and said that because I was a good customer, he would credit me the NSF fees and to call back once I thought all my transactions had gone through, which I did a couple of days later.

    Upon calling John kept me on hold for a few minutes and told me he would only be able to credit me 25% of the $455 worth of NSF fees. Had he told me that when I called the first time, I could have borrowed the money from my mother (another Wachovia account holder) to decrease the amount of NSFs. But because he assured me they would be taken care of I didn't bother with making any arrangements to counteract any of the transactions that were going to hit. I then asked to talk with some one else and was transfered to Tsequanesh Debretsion who kept me on hold for 5-7 minutes and then returned the same answer and then hung up on me.

    I no longer feel safe having Wachovia hold my main account. I am down $350 dollars in NSF fees when it could have greatly been reduced if I hadn't been lied to. I had to borrow money because I have car rentals, home maintenance scheduled and child care to pay for and groceries to buy. I think I am going to take my money where I feel more secure.

    After being fed up of paying fees, I called Wachovia and cancelled my overdraft protection (thinking this would avoid the transfer-funds fee) and asked they DO NOT approve any transaction that would bring my account into a negative balance. Sure enough, a few days later, Wachovia Bank paid out hundreds of dollars to a company that withdrew funds from my account without my authorization. After questioning Wachovia, they did tell me that the company did not obtain authorization and Wachovia doesn't know why they even released the funds to the company.

    In any event, this caused my account balance to fall, leaving just a few dollars in my account. I used my check card like normal not realizing that money was removed from my account. Wachovia approved all of my transactions for the day and I did not even find out about ALL of this until a day or two later when I checked my account online. I was wondering if Wachovia was going to bother to call me to let me know what was happening?

    Anyway, they of course added on LOTS of fees. The were Unavailable Funds Fees of $22, and then Non-Sufficient Funds Fees of $22 for the same transactions. No one at Wachovia could even explain these fees to me or how they were assessed. On top of it, even though they saw that I told them not to approve transactions that make my account negative, again they could not explain to me why they approved the transactions after i specifically asked them not to. From where I sit, it does not look like Wachovia cares anything about their customers and assess fees however they can and wherever they can. Their commercials claim they are number 1 in customer service...I don't know how that happened!

    I have had over $800 debited from my account in an unauthorized transaction, plus $132 in fees from Wachovia, and then another $50 in fees from the credit card bills that I tried to pay from my account that were returned because funds were not available.

    I had a cashier's check to cash that i was weary about and explained this to the staff when i arrived. I asked them how long it takes for one to clear and they told me that is takes two days tops and i got the check cashed and waited. I waited the two day they told me and went back to the same bank to make sure that the check had cleared. I specifically informed management again that i was unsure and that was the reason i was checking.

    They told me in these exact words that there was no hold on my account and that the check was good and it cleared. Still insistent there could be a problem later i held onto the money for another two to three weeks to make sure that everything was fine. Figuring it was a cashier's check it should be almost fool proof, waiting the two days they told me, going back to make sure there was no hold, and still waiting three weeks before i touched the money; i figured that it was okay to disperse it like i had planned.

    Then a little over a week later, June 6th, i my statement makes me aware that the money was charged back to me stating that they were not able to collect on it. After explaining the case again to bank manager they are claiming they have no responsibility for the other bank sending the check back late, because they are suppose to send back with in two weeks if it is no good, and then telling me they don't know why they could not get payment. I don't see how a large branch like bank of america cannot tell me within three weeks that a cashier's check for 3,950 is no good.

    I am upset that the bank claims no responsibilty even after i took every precaution to make sure this would not come back to me. I am appauled that after i explained my suspician they didn't tell me to wait at least a month to be sure. I felt that they didn't bother listening to me and are so quick to say that they are not responsible. I told them from the get go that i do not have the funds to back up this check and that is why i am checking to make sure it has cleared. They actually thanked me for coming in to take that extra step and i again told them this has to be clear and that they are certain. Two associates, one being a manager checked and promised me that it was fine. And now they are charging me back this money and are not trying to pursue the bank that authorized the check.

    This has created the biggest strain ever on both my family and my relationships. THey are refusing to temporarily freeze my account and waive any overdraft charges. This will hurt my credit because i don't know how or when i can pay this back even though i feel it is mistake on the bank's part that lead us here, and it is the bank's because of the promised i received amd the precautions i took. I just bought i ring for my girlfriend hours before i found this out and what should be one of the happiest days in my life has turned into one of despair and hardship. This problem with the bank has caused me severe depression and anxiety and i feel that life can not be good or the same for a very long time without some serious help

    BofA closed my business account to further charges based on information we obtained from your account, as well as from information reported by a major credit reporting agency. I was not, and am not, in default on the account, or on any credit card account I have. Due to a late payment, perhaps two, over a period of two years or so, my interest rate at the time they closed off further charges was 19.24 on purchases and 23.24 on cash advances. Kind of high, but I have other credit, and I decided just to pay the monthly bills and not complain, which I have done, regularly, on time.

    Yesterday, I received an amendment notice stating they're raising my interest rate to 27.99 -- not based on anything related to the closed account but again on information in the credit reporting agencies files. According to the BofA representative I talked to on the telephone just now, the increase is because they have determined I'm a risk. (My credit score does not bear this out.) I can't close the account to stop the increase (it's already closed). Apparently, they can do whatever they please, including charging me another $30 or so interest per month, just because they feel like it.

    Wachovia Bank Charges Excessive fees. How can a bank charge you overdraft fees twice in one payperiod, not only did charge me thirty-five dollars twice for a $4.00 overdraft. The Overdraft resulted from the fees Wachovia charges for a customer using a non-Wachovia, ATM the Non-Wachovia bank charges you ATM fee, and Wachovia charges you for using another banks ATM. Each time I used the ATM in the building where I worked, Wachovia was charging me to access my own money, without ever informing me that this was their policy. So that when I realized that I had acquired a $4.00 overdraft, and Wachovia charges $35.00 for each overdraft.

    I've been laid off for a year and a half, and I just got a permanent job this year. I'm trying to get back on track with my bills and rebuild my life. My home is in forclosure, and I'm about to get a divorce. How can a financial institution like Wachovia be allowed to double dip, like that and your not able to report it. FOR A $4.00 OVERDRAFT, WHICH WACHOVIA CAUSED BY CHARGING ME TO GET MY OWN MONEY FROM THEIR BANK THROUGH ANOTHER BANKS ATM......I WAS CHARGED $74.00. What can be done?

    Wachovia decided to handle my debits instead of credits first causing my account to hit $210 in overdraft fee's. I am disabled and I will not eat this month because of it.

    I am 100% disabled and I live on less than $900 a month and that includes paying rent. Be cause of Wachovia i will not eat this month. I am taking them to small claims court.

    After years of suspicion that BOA was ripping my wife and I off, the last straw has landed. On March 24, 2008 my wife and i purchased a trip package to cancun. The airline tickets were charged seperatley from the hotel package through Expedia. The next morning while checking my accounts i noticed that i had been charged for 4 tickets. Not 2 tickets as actually selected. Under further investigation we noticed that there were actually 2 sets of transaction #'s. one for my ticket and one for my wifes ticket, then the exact charges including Transaction # were Duplicated.

    On top of that we were slammed with 150.00 worth of overcharge fees because that action as well as other banking actions had sent my account spiraling into the negatives. after some phone calls with some not so willing staff, we were givin a credit to make up everything. then 3 weeks later the amount of one of the tickets was STOLEN from my account by Bank of America. This being a holiday weekend of course we recieved a letter saying that the airline had declined any wrong doing. with little time and a hot head attempted to contact bank of america and like so many other people encountered BOA staff that was rude and discourtious.

    this is know in the third month of this So Called investigation. I have since closed all my accounts except the one under contention. BUT i Will NOT GO AWAY. I work hard for my money and i am not going to let some bank who thinks that they are above the law. this is my money and they made a mistake and know they dont want to play by the rules and give me my money back. this has gone past the point of being reconciled. I want to be compensated for my troubles.

    i had purchased a money order from money gram that had been stolen and wrongfully cashed by b o a. the money order has sent 2 demand letters to b o a and they have yet to respond. i would like to know why and when they will get this taken vare of.

    i am still fighting eviction from my apartment complex becouse this was my jan rent. someone was arrested and will be sentenced for this crime this month. i would just like to get this money back so i can resolve this situation.

    On May 20th, I checked my account online and had a balance of $8.54. I had my husband deposit $100 at 8:32am and another $351.36 at 10:16am. My husband asked the teller to cash and deposit the checks. This is documented on his deposit slips, which we have a copy of. The teller did not cash and deposit them, but simply deposited them, therefore BOA put a hold on the deposits until 5/22.

    When I checked our account that evening online at 5:02pm, we were negative $118 dollars because they posted five pending transactions from 5/19 AFTER our deposit.

    We called and talked to customer service at 5:10pm and she said that it was the tellers mistake because she did not cash and then deposit our checks as we specified. She said that there were not any overdraft fees and that we could go in the next morning to the bank and they would fix the problem. She recorded this in her notes. I checked the account a final time at 6:47pm and we were now negative $293!! They charged us $175 in overdraft fees after we had deposited $450 that morning!

    The bank manager would not help us and continued to place the blame on us and not the teller! They also insulted me by claiming that I was not one of their premier customers so they would not refund me the fees! I have deposited over $40,000 with them since January! Just what does it take to be a premier customer!?

    I travel all over the world and do not like to carry large amounts of cash but prefer to use my ATM card in the country I visit. I notify B of A before leaving to let them know that I'll be traveling to other countries and using my card so I don't have an issue. I went to China this week and used my ATM card with no problem.

    I tried to use my ATM card again and found that it was blocked. I sent emails to B of A customer service and they told me the only way to unblock the card was to call a phone number in Atlanta. I told them that I had no phone and could not call. After 5 more emails, they still gave me the standard answer that I had to call to have it unblocked. Not sure why since I had to use a password, answer a secret question, and then confirm a site key before even sending an email. What's the point.

    Needless to say their customer service rep's, all in India, did nothing but say they can sympathize with me. Not sure how since they were not stranded in China.

    My pay dates have changed from the beginning of the month to the end of the month. I don't like to make late payments so I contacted Wachovia about changing the due dates on my car payment to better fit my pay schedule. THe woman I spoke with out of the local office faxed me the paper work, which I in turn signed and faxed back. SHe told me it would be for the current cycle and my payment was now due at the end of the month. Pretty soon I started getting phone calls ( 4-5 a day) in which I explained about the payment change, they told me it can take some time to update, apologized and told me to check up on it. I did and was told by Brian in the local office my request had been denied, i asked why that information had not been passed on to me and why it had not been availabel to the agents calling me, he said he did not know but suggested defering that months payment as a solution to the situation. I payed the 25.00 deferment fee, signed and faxed back the papers and thought we were all set.

    I WAS WRONG!!!!! I received a call this evening from Wachovia, "Maam you are 31 days past due we need to arrange payment immediately or we will repossess your car!" I have not made late payments previously, I have been a good girl, pay like clock work and they were going to repossess my car? I explained the whole story beginning to end and asked why if I defered that payment I was late... the jerk transferred me to my local office (in a huff) where I was greated by another jerk who immediately started telling me there was no record of any sort of deferment offer, I calmly explained "I have a copy of ALL the paperwork here, its even time stamped from your and my fax machines" to which he replied " a whole lotta good that will do ya, you are still 31 days late, would you like to make a payment today or shall I arrange for a repossession?"

    After a half hour of arguing back and forth I finally just made the payment asked since I had all the documentation if this would still be on my credit report, to which he replied " well you were late!" I said " but I had filed paperwork with you twice! and you guys failed to inform me of the first one being declined, this one you flat out lost!" he said 'prove it' I told him I had payed the 25.00 fee, he told me he didn't know what that was for for all he knew it could be for late fees. Mind you I have NEVER paid late and thus would have no late fees, something he could easily see on his screen. I hung up have left messages for ALL his supervisors for tomorrow and am waiting for this to show up on my Credit report. After this ordeal my husband told me to just pay off the F***ing loan so we will be taking the money out of our savings to do so. This was supposed to be a way to build credit as young married people starting out not get screwed by it.

    I banked with Wachovia..well def. not anymore. I recently have been charged 2000.00 in over draft fees. I had companys just charge over and over again on my account and Wachovia did nothing to stop them. They re ran checks two and three times a day for different amounts of drafts. I ended up with all that in over draft fees. I have not paid those fees as I kept asking Wachovia what to do and there was nothing they could do to help me. The money is now in collection and has been put on my credit. I'm unsure if what they have done to me is even legal..Any advice?

    We became 3 months behind on our business loan with BofA. We have been customers of BofA since 1987. Without a warning they ZERO'ed out our checking account $ 5978.21--wiped us out. We had been struggling to keep up with payments and also had a debt consolidating firm assisting us. This was devastating, financially. It was immpossible to get someone one the phone(in our panic) and then were told debt offset. We feel this was an unauthorized debit--STOLEN FROM US--with no one would reverse. (we would have paid the 3 month back debt...)This completely broke our trust in this firm.

    All our monthly automatic withdrawals bounced--adding further to our economic hardship--rent payment was not there, as well as the monthly allowances for food, gas, transportation, medications, etc.

    I was flat broke, I stopped using my bank account at Wachovia Bank. I had 0 Balance. I told the bank to avoid any overdraft fees please do not pay any automatic debit that might be billed. Mainly I have a lot of services online that might end up rebilling that I may have forgotten about. They agreed and had it on my file.

    I recently received a letter from them telling me my account was -$110 . I immediate called and asked them what bills the paid and why? The said they didn't pay any bills but a domain company that I bought a domain from 5 years ago automatically tried to renew the domain and retried 3 time after they declined payment. BUT The still charged me every time for insufficient funds fees each time. resulting in the -$110 balance.

    So Not only am I am broke . My bank is charging me because I am broke whether or not the paid anything. How is this fair? They told me I should have closed the account . But I need it just in case ,instead of cashing my paycheck for bills I could deposit some money. But Wachovia didn't care the think because they were asked (but didn't pay) they should charge me a fee. Is this fair? My bank making me more broke? STAY AWAY FROM WACHOVIA BANK!!!

    Now they are suing me for the fees and reported me to some agency to make it difficult to open another bank account.

    I borrowed 15,000.00 in a school loan from a reputable bank (NOT Bank of America) and it was addressed to myself and my grandfather (co-signer). As I have been depositing large amounts for the last few years as my school loan checks come in I did not worry about depositing my 15,000.00 check into the ATM. This was a big mistake! Because this particular check was addressed to myself AND my grandfather they said they could not accept it. However, this was after they put the full 15,000.00 into my account which I saw through my online banking webpage the day following the deposit and I started writing checks to pay tuition, rent, etc. This amount was not in the pending section it was in my account, all 15,000.00.

    Therefore, I wrote all these checks and was using my debit card only to find out a week later that had pulled the whole 15,000.00 check out and began docking me 25.00 overdraft fees and then 35.00 overdraft fees, and then 35.00 NSF fees for all my checks that began to bounce. In the mean time I had just closed my campus mailbox where BofA was sending all my banking mail (and lots of other things were being sent there also) and was in the process of updating my address with all of these companies. So when BofA went to return the check, they sent it to my closed campus mailbox thus leaving me with no choice but to wait for my check to make its way back through the post office so I could add my grandfather's name to my account and get that check deposited back into my account.

    Okay, what my problem with BofA is: They put the whole 15,000.00 into my account leading me to believe that I was safe to write checks and pay my bills with my student loan check and then later that day they took the full amoutn out without notifying me directly. If they discover that one or more of the payees of a check isn't on the account after they have deposited the check in full amount into your account, they need to notify you directly not through snail mail which in my case got sent to a closed campus box leading me to accrue unnecessary bank fees.

    To date, BofA has charged me 511.00 in both overdraft fees and NSF check refund fees. I spoke with Charles Lee at the Alta Loma brach where I originally opened my account four years ago and he assured me these fees would be taken off. He gave me a card with a Customer Solutions Center's phone number on it and told me to call and they would take care of the fees. He even said he put a note into the system about me calling. However, upon calling today the Customer Solutions representative I spoke to refused to refund the fees and when I asked to speak to his manager he would not let me stating, This is the highest your call can be escalted to. I have since tried to contact Mr. Lee but surprise, surprise the number he gave me to reach him is out of service.

    Because of Bank of America's hugely unfriendly staff, unhelpful customer service representatives, and poor communication with me I have had to go 2 whole weeks without any money, use 511.00 of my school loan money to pay BofA fees, wait two weeks for the check they sent to my closed campus box to make its way back to me when I would have come to the branch to pick it up had they called me (you know, it being such a large amount), I had my school threaten to kick me from my summer school courses because the check I had originally wrote them after double checking that the money was in my account bounced, and my reputation is ruined with them. In addition, my grandfather has had to take off of work just to come to the bank with me to put his name on my account and because they treated me with such little respect I had to bring an older man just to get them to give me any real answers. Answers that in the end, got me nowhere.

    I made some purchases (3) with my debit card (actually entered my pin) and that is basically like going to the ATM...the money is deducted from your account right then and there! Well, I used my debit card, thinking the money had already been deducted, I made two additional purchases two days later. The day after that I go to use my debit card and it gets denied. I am thinking "no." "I have funds available." I go online to check and see that I have 5 NSF fees!

    I called Wachovia and the representative said that when even though the purchase was made on a certain day that it did not come through to Wachovia until 2 to 3 days later! That is a bunch of [lies]! I told the rep. that the card I used was my debit and when you use a debit it is just like using the ATM, so the money comes out right then! The Wachovia rep. just repeated the same crap over to me again. Later I get my statement and see that the debit transactions are actually listed as posting days later, but on my purchase receipts the purchase date is 2 to 3 days before!

    Now, I can see a transaction posting that late if a credit card is used because of processing time; however NOT with a debit card! The money should automatically be deducted when the purchase is made. What Wachovia does is they have the debits set to purposely post late, so that people will continue to make debit purchases thinking they have money available. Wachovia practices are unethical and they should be reprimanded for such unacceptable practices. They basically stole money from me. I work hard for my money and I ended up having to pay NSF fees to other business as a result of Wachovia's greed.

    These guys charged me four hundred and fifty-eight dollars in overdraft fees. I thought I had 1.50 in the bank when I made a two hundred dollar deposit. Essentially, what did happen, was I was charged overdraft fees on transactions in my account when those same transactions showed up in the black on online banking after making a two hundred dollar deposit a week before the two hundred dollar deposit already referenced above. Given that I can count to two hundred and I thought I had two hundred in my account I spent it, unaware that I had three fees charged to earlier overdrafts that originally showed up in the black on my account the previous day. My spending two hundred, while I actually had 95.00 dollars after they charged the fees, I ended up with more overdrafts. I got some action after complaining relentlessly.

    Iif I continue to bank at BOA, I am self diagonosing me as officially out of my mind. Therefore I'm closing my account today.

    I have a joint CITI credit card with my aunt. Citi sends me checks to do with what I want. The credit limit is $28,000+ with a cash advance limit of $15,000. This account has been perfect for 4 years. As I needed funds I would deposit these checks from a stub pad. The stub had the date of expiration but not the check. One time I realized I deposited a check with the expiration expired. Citi cashed it and said I had this opportunity till the end of 2008. When I received the next batch of checks I was going to make a deposit so I removed the check from the dated stub. But I didn't use it then. A couple of weeks later I needed funds and used the check I had removed from the stub pad. I deposited the check and the next day withdrew the funds. Unnotified to either me or the primary cosigner Citi refused the outdated check. Now my record will indicate I have done this numerous times before and almost always withdrew the funds the next day. It's common sense, when your take advances you need the money so why is it fraud to remove it right away.

    So BofA closed my account but oddly accepted a wire transfer from the same institution that previously denied to cash my check. Now BofA has me on chex systems and is in possession of my $600 wire @ over 20% interest since May 9 2008 and I have no access to funds I must repay at a high interest rate.Now I receive a statement from BofA that I got debitted $35 for a bounced check and $60 for account review. BofA asked me to confirm by notary that my cosigner of the Citicard knew of my transactions. My aunt did so immediately and verified that I have full authorithy to do as I wish. This was faxed with receipt on May 9 2008. After countless follow ups all I get is rude hangups or it's under review. What is to review. I proved it's no fraud and have a history of these transactions. All this happened because I mistakenly depostited an advance check that was expired and these checks have no expiration date only the stub does.

    Now I am barred from opening amy account because BofA reported fraud to chexsystems. My cosigner who by notary confirmed she was aware and consented to my transactions was rudely hungup on by the agency that requested proof that no fraud was committed. Without a checking account I now must use money orders at a cost to me and not have access to direct deposit of my income pay. I don't blame suspicion by BofA but I have given them all they asked for to clear my name. Why didn't BofA contact me via my cell they have my number. Why wasn't my cosigner contacted via Citi?

    Cost of money orders, delayed access to biweekly pay because of no account for direct depsoit. Loss of $100 for opening chase account with direct deposit due to chexsystems. Telephone correspondance waiting on hold for countless minutes while being rudely hungup on. The cost of my wire advance of $600 since 5/09/2008 without access and the cost of $60 review. My gas to go to differebt branches of BofA and time off from work. My emotionly state has caused depression, my erratic behavior by missing work almost to lose my job. My nerves have tensed everytime I see a BofA ad or branch. I have lost hours of sleep trying to figure out how to resolve my conviction and sentence by BofA without a trial.

    I talked to a representative concerning my account because I had been charged a $105 in NSF fees. She informed me that Wachovia pays the highest amount first and then the lowest amount, regardless of what comes in first. I must say that the representative was very nice but as I begin to question her about this practice her responses became somewhat shaky.

    I firmly believe that credits should post first and then debits should post as they come in. Wachovia should not have the right to decide what is paid first.

    As a result of this practice, I paid a $105 in fees.

    My husband has been with Wachovia since he was 18 at which time it was First Union and was eventually bought out by Wachovia and he kept his account with them and had fairly decent service for the next 9 or 10 years. However for the last 3 years we have had the worst experience possible with them. We have had our check card numbers stolen and large sums of money charged to our accounts and when we call they tell us there is nothing they can do until it posts to the bank so I then have to do the leg work and get the transactions canceled and file charges.

    I have also asked repeatedly for both mine and my husband check cards to be canceled to avoid this happening further only to call the next day and find out they weren't closed. It finally ended up that 3 days later my husband who is in Iraq had to call them and argue with them to cancel the cards and issue new one which we don't even want because we are leaving the bank for another that is more reliable. We also have overdraft protection on our account which never seems to work and we always get charged NSF fees that we then have to call and argue about until we finally get them back.

    Today I was looking at the account and noticed some strange charges so I called and the lady told me I disputed something in April and never responded so she gives me the information for the company and tells me I need to call them so I do so and they have no record of a charge ever being made. So of course I called back and the lady looks into it further and finds out some stupid dispute investigator charged the money to the wrong account so her supervisor gives me my money back after and hour of aggravation and trying to figure out what was going on.

    I really don't understand how a professional corporation can make as many mistakes as they do. I really do believe that they love to scam there customers to make money. Luckily we got all of our money back and are now waiting for all of our now in the process of transferring our money to a different bank.

    On Jan. 15, 2008, I opened a free checking account with Wachovia Bank (#1010192166692) and then on March 20, 2008, I opened a savings account, also with Wachovia Bank (same branch) (#3000112166790). I CLEARLY stated to the officer establishing said savings account that under no circumstances do I want the two accounts to be linked as I cannot keep track of constant transfers from one account to the other and vice versa. He said that was fine.

    On May 5th, 2008, they transferred $196.37 from my savings account to my checking account without my knowlege or authorization! I physically went into the branch to deposit an additional $1000.00 to cover the overdraft that I thought had not yet been taken care of. Had I known they were going to transfer funds to cover it, I would have not gone in and thrown another $1000.00! I am an unemployed single mother desperately trying to save thousands of dollars to move my child and myself back to California as things are no better here in Georgia as they are in any other state in the union and we'd rather be home.

    am FURIOUS that they not only transferred my moving money when they weren't supposed to be doing that AND still charged me hundreds in NSF fees! They cannot have it both ways! This should be considered theft and illegal! NEVER AGAIN will I ever in my lifetime open both a checking and savings accounts with the same banking institution! Banks view this as invitation to do whatever they chose with my money regardless of how my accounts are set up!

    This is both ridiculous, highway robbery and I will not tolerate it! What good is a Customer Service Dept. when all you get is lip-service and the run-around with no positive outcome of your complaint. I suppose this is where you guys come in. They should all be dissolved - banks! They are all thiefs! I will now have to stay here in awful Georgia for another full month, miserable in this heat and my current living situation where we are being abused every moment of everyday. This is causing me emotional and mental distress! Wachovia will transfer my funds in the amount of $196.37 back into my savings account and will reverse all NSF charges incurred since the date this account was opened in January 2008.

    Once I receive a phone call from a bank manager advising the above has been done, I will go into my branch and close both accounts! I will never again put so much as one single dime into Wachovia and will insure nobody I know will either. Matter of fact, I will no longer use banks. I am hereby boycotting them all. I will simply have my mother cash my checks at her bank and use .50 money orders from Seven Eleven or Am/Pm mini markets to pay my few bills each month and will keep my cash at home in a fire proof safe. Who needs banks?

    I have had two problems with BofA. The first happened when I was young. I joined the military and was required to set up direct deposit. I opened an account with BofA. While I was out in the field in NJ for training my account was emptied. I called the bank a couple weeks later when I got back in and they told me I had taken the money out. I explained that I was the only one with access and that it was impossible because I was in the mountains training at that time. They never gave me back over $700.00. That was almost a months pay for me.

    The next thing happened when I moved to Michigan. I closed my BofA account because we did not have them here (now they have bought out LaSalle bank which is the worst bank on the face of the Earth). I was negative $84.00 in the account so they told me to send a money order to cover that. I did that immediately. They received it, signed for it and posted it. They even sent me paperwork showing my account closed. Which is why I was surprised to find it on my credit report as a negative hit. They said I owed them money. It also showed on my Chexsystems.

    I, like everyone else on here, called them and called them to no avail. They don't care and continue to report on my credit report. Couple that with shady credit reporting agencies who don't remove false info even with proper proof, and you have one huge mess that only hurts us. Nobody seems to care about the consumer and how it affects us and our lives. I can't even open a bank account because of these people.
