    My partner and I share a joint checking account for shared expenses. We occasionally use it as a convenient way of reconciling money owed in lieu of paper checks. I transferred $426 into the account one night and she subsequently withdrew the $426 into her personal checking account. When she signed in, the available balance was shown in the account, so one would infer the funds are available. However, the transactions posted in the opposite order, a withdrawal THEN a deposit, which put the balance in the red. This wasn't shown on the account and we used the card for dinner that night. Well, the deposit didn't post until the next day so we got hit for two overdraft fees at $35 each.

    After 35 minutes with a customer service agent, I'd had enough and wanted a supervisor. The supervisor in 'customer support' conceded the fact that it was a misunderstanding but the fine print strictly states that because the bank is technically not at fault, he's not obligated to waive any fees as a courtesy. As a member of 9+ years of BoA, I was floored. He finally agreed to waive one of the fees... despite the second fee inherently being a result of the first fee. I said, “If you understand the order of the postings for these transactions was the culprit, and agree that neither fee would have occurred otherwise, why not waive both fees?” He said, “There's no way to tell if the account would have been negative even if they had posted in the right order.”

    I noted that as a banker, this should be an easy process to walk through the 2 transactions, so I did the math over the phone. He again agreed that neither fee would have resulted but there's still no way to tell. Confused? Me too. I explained that many banks would be happy to earn new accounts and I refused to carry a relationship with a bank that squeezes every fee out of me possible. He was happy to grant 1 of the 2 fees back and wished me luck in the hunt for a new bank.

    All over $35. A Customer Service Supervisor wishes a decade-long client farewell in the spirit of retaining a $35 fee. This is the level of support you can hope for at Bank of America. I didn't know $35 could upset me so much...

    I went into the bank on 2/11 beacuse it shows online that one on my transaction had cleared an left a bal of 10.66 and wachovia then charged me 35.00 for a transaction that they say cleared which put my acct in negative by 24.34 as of the 9th there were two more transaction that went thru on my acctount which caused my account to be overdrawn by 105.53 when one of the transaction should have cleared and my acctount should have only been negative by 35.56 beacuse i was .56cents short on one af my transactions.. when i showed the agnet matt the print out that i got from wachovia online website showing him that the transaction they are charing me for has cleared and left a postive balance the agent says that it didnt and i needed to contact the store and not wachovia . even with black and white in my hand showing him a print of there website that they say is to help the customers mantain there acctounts but if it does not that why give us online access

    For over 22 years I have had an account with Prudential which was subsequently purchased by Wachovia. At the time I was a real estate agent with Prudential and we were promised that we would never be charged a fee as long as we had the account. When Wachovia purchased Prudential they sent us notices that business would be as usual. No changes. Well...there was. This year I discovered that Wachovia levied a $150 fee on my account. My daughter works for Banco-Balboa Compass in Tucson. I get free checking. Free everything actually. I would have no reason to continue with an account that charges a $150 yearly fee. When I questioned it my account manager told me that the previous manager was waiving the account and that there was no way he (current manager) was going to pay for the fee. I went to the SEC three times. All they did was send my letter to Wachovia. The customer services manager at Wachovia did acknowledge that the Prudential folks who signed on with me were indeed told that we would not be charged a fee then she attached all my statements. What? I have all my statements. I have tried several times to recontact the SEC and get nowhere. Any suggestions? Thanks! Joan Tober

    My husband has an auto loan through BofA. Our payment is due on the 4th of each month. For over 4 years, we have made our payment between the 10th-14th before any late charges can be accrued. We received a collection call on 2/7 indicating we would be paying by the 14th. We received another call on 2/9 and I mentioned to him that they just called 2 days prior and it was my understanding that in the State of California, collection calls could only be made every 7 days. He disputed that he was making a collection call, but a courtesy call. Needless to say, he continued to argue with me and as far as I'm concerned, this constitutes repeatedly calling on this account. I asked him to not call again unless I failed to make my payment by the 14th and he said he would not stop calling until we paid.

    Bank of America is charging me $35.00 overdraft fee. However, the statement doesn't show at any moment that the account was negative. This is not the first time. Every time I called their customer service, the explanation is different. The procedure is different to justify those fees. Later I found out that Bank of America customer services is not part of Bank of America. This is a different company called Convergys, which you give all your information and access to your account. They cannot solve anything or give exact information about some issues. They are not Bank of America employees (they are trained to say so). If need something to be solved, you need to go to the branch so you can talk to a real Bank of America employee. Pay attention to it. Be aware! Get out of this bank!

    My first big issue started on 2/3/09, when I had to make an emergency trip from VA to NY. In doing so, I thought I was going to come close to overdrafting. So I went to transfer some funds from my savings to checking when I was purchasing fuel and I couldn't reach the mobile BoA site. I thought, "No biggie, I'll do it from home," which I did. Checked my account and I still had sufficient funds and transferred what was needed to ensure the account would not be in the red. Well BoA decided that in the background (not visible to me), that they were going to assess a $35 overdraft fee which applied immediately, but was not visible. Subsequently, 3 more $35 overdraft fees that took yet another 24 hours to become visible before posting.

    I called them to figure out what was going on and told them the situation. They refused to issue me credits. Now mind you, when I went on my account there was no negative balance. If the overdraft did not occur, there would have never been any issue. But they are inflexible and they have claimed $140 of my money. Now I am not excusing my actions of making my account draw too close to the edge, but I made transactions to make sure this would not happen. According to the account online, it was OK. Even further they did not apply overdraft protection that I requested 3 years ago.

    Then to sour my relationship with the bank further, I got three letters in the mail on 2/8 saying they are closing my credit card (and my wife's) and line of credit. Mind you, I have never been late on payments and even pay 20-50% more than what is required. Like Steve of Ozark, MO and many others, we are bailing out these too big to fail banks with our tax money while at the same time they are shedding customers that they deem either too risky or not risky enough.

    Around 4:40, I walked into my local Bank of America (201 E Central Texas Expressway 1900, Harker Heights, TX 76548). No one greeted me and I proceeded to the waiting lounge in the middle of the bank between the tellers and the customer service offices. I'm a patient person but I watched two Hispanic gentlemen walk in and proceed into my direction. Before they could sit down, they were greeted by one of the customer service reps (**). She spoke to them in Spanish, looked in my direction and they followed her into her office. I gave her a look of disappointment. (I have been waiting patiently for someone to help me, yet they walk in and get helped as soon as they walk in the front door.) She did come out of her office and asked me, "Do you need something?" in a most unfriendly way! (Should it have been, "Can I help you?" not "Do you need something?" What kind of question is that?)

    I had my bank credit card statement with me as I proceeded to explain what I needed help with. She quickly took the statement from me and rudely interrupted me with, "What is this?" I then stopped finishing the reason why I was there and kindly told her it was my credit card statement, and she responded, "Well, you can call a 1800 customer service number for that" and walked back into her office, never asking if there is anything she could do to help or if I needed any further assistance with anything else! How could I tell her what I needed when she rudely interrupted me while I was trying to tell her what I needed! After she walked back in her office, I sat there in shock! Are you supposed to make a customer wait while she helps someone else who walks in after you? And she saw me seating there as she escorted the two gentlemen into her office.

    And why is she conversing with me over my account info in a main lobby? Is that not what the teller's office is for, the ones with doors on them for privacy!? This is not acceptable! I'm a conscientious white American! I'm not Spanish! This is America and I speak English. Does this Spanish speaking person prejudiced because I'm a white American? Can you give me a good reason why I shouldn't get a lawyer over this discrimination? As I sat there stunned, I decided to walk myself to her office and asked for assistance! She told me, "I'll be right with you later. I have these two customers." I kindly responded that I needed a supervisor and should not wait any longer for assistance. She proceeded to tell me I will have to wait until she is done with them. I told her I want a manager now, not later as I'm sick of waiting. The manager escorted me into an office and said she is sorry for the other rep's delinquency!

    Not much time passed and the rep came into the office I was seating at with the manager and she interrupted me again as I sat there and was trying to explain to the manager! Is this the kind of confrontation I should be subjected to!? This is not professional and unacceptable! My time is valuable. I don't have time to explain myself to a manager while a rep interrupts me! Then the rep said, "You forgot one thing, sir. You did not sign in! You have to sign in to get help." Then I went off on her and responded, "Did the two Hispanic gentlemen sign in? No, they did not! Yet you kindly took them into your office! And where are they now? They're gone! You helped them, yet I'm still seating in this bank and arguing with you!"

    Maybe you think this is not a racial issue, but this is not Mexico! And if I sound racial, then maybe you need to send this letter to someone else in the Bank of America department because the facts speak for themselves! There is a racial issue here and I did not do anything wrong, besides have a rep disrespect me and treat me in a way no one should be treated. You have my money in my credit card account and I'm sure the more money you have to play with, the more your bank grows. Is that what I'm here for? To be subjected to having to wait, never be greeted, have to watch someone who walks in after me, after I've been waiting and waiting, only to have them helped, and then be told I needed to call an 800# because she is too busy now helping someone else who walked in after me, only to have my credit card statement taken from me and conversation over for a split second in a non-private area (waiting area), not a nice little office with a door.

    I guess that is for special people, people who are not American who speak anything but English! Then to have a customer service rep argue with me as I am trying to explain the situation at hand with a manager! You don't do this! You don't have the rep with the customer in front of a manager especially when the customer gets interrupted! I am to explain myself as if I'm some kid. I guess this kid can take his money out of the Bank of America on my secured card and look it up! See how much more I put on my secured credit card that same day! I might not have a fat account like some, but you do have my money though I'm white and not Hispanic. I'm looking forward to a response soon!

    Today, Feb. 6 2009 at approximately 5:15PM, I went to BOA in Yuba City, CA to cash two checks drawn on a Bank of America business account. I waited in line for approximately 28 minutes to cash these checks. I got to the teller, whom I thought was the manager. I started to sign my checks as I've been doing for the past years, when she told me that I would have to have the checks verified. I have been going to this same Bank of America in Yuba City on Butte House Rd approximately four years, cashing these same checks drawn on the same business account with Bank of America. She told me that I would have to see somebody at the desks.

    I walked over to a lady at a desk and asked about verifying checks. I showed her the checks. She typed on the keyboard and asked me if I was a signer on this account. I told her, "No, I'm not. I am here to just cash these checks just like I've been doing for a while now." She asked me if I have an account with them. I told her no. She said to me that if I had an account with them, this would not happen. Wow! I am not a stranger at this bank. This is yet another ploy or policy of this bank to direct you to open an account. The first being the $5 charge per check cashed for being a non-account holder. Is this a legal charge? I would guess that in approximately four years at $5 per check, the fees would be around $1,140.00 that I have been charged to cash checks drawn on this business account with Bank of America.

    The lady at the desk verified the checks. I asked her, "Do I have to do this every time?" She said yes and stood up. She then walked me to a teller and said she will have this teller take care of me. I asked the teller if this was something new to have checks verified. She stated that all non-accounts would. She also asked if I would like to talk to the manager. Yes, I would like a chat. The teller cashed the checks and at this time, I was calling the business that issued the checks.

    Robin, at the issuers of the checks, answered my call. I stated to her that I have been made to wait to have their business checks cashed. She told me that she thought that all issues with this bank was resolved. I then told her this new issue has risen. The first issue was the $5 fee. I told her that I've always been charged a $5 fee per check. I then stated that once in a great while that I hadn't been charged. I then remembered that I didn't get charged when the Merchant Tellers cashed my checks. That would be only less than ten times in all the time going to this bank. I went over to talk with the manager, a Mike **. At this time, Mr. ** was explaining to another customer that this is a new procedure. Robin is still on my cell phone listening to Mike ** talking.

    Mr. ** also stated that these kinds of accounts have to be verified due to the increase of fraudulent checks being cashed at this bank. He also stated that he had to fire one of his tellers because of not charging the check cashing fees. Again, wow! Robin, who was listening asked to speak to him. Mike ** said he will not speak to her on the phone. I left this bank after approximately 45 to 50 minutes to cash two checks totaling less than $600.00. My time is worth a lot more than these policies.

    I am 48 years, young, single father of three, and I work very hard for every dollar I can get. This bank's policies make you feel very uncomfortable and ripped off. What choice does one have to even try to stand up to this kind of bank practices? I have my reasons for not wanting to open an account with BOA. It's like you have to jump through their hoops and dance a jig to get your hard earned money.

    I have been having issues with BoA. This last time, it was all my fault that I went in the negative but before my account will go into the negative and I called the 1800 number and they can't tell me why my account is in the negative. I asked what the transactions were and they told me that they cannot give me any information about it. This has happened 2 times and I was reading what else BoA has been doing and noticed a lot of people are saying they get charged $35 overdraft fee. I'm getting charged $39 fees. I do not understand I have never had any problems with BoA until the last couple of months. I don't know what is going on but I'm not staying with them. I can't afford to keep paying them. I have already paid the well over $700 and they can't tell me why. I'm sick of it. They used to be a pretty good bank but not anymore.

    In 2006 I had co-signed on a credit card for my then fiance (don't ask me how a 20 year old was approved for that with less than 2 years of credit history). We had our troubles in the relationship and I had closed the account in 3/2008. I was lied to by the teller at the branch when I did so. She told me that upon closing the account I was no longer liable in anyway and it would not impact my credit. Even with a balance in the account while she was paying it off.
    I was told by my ex-fiance that the card was paid off in full last year and I've come to find out (only by running a credit report) that the account was still there, collecting interest, and was not paid since August. My credit score was destroyed because of this. A week before this I had recieved a call from someone claiming to be Wachovia, but it sounded fishy and I thought it was a scam. I called the number back and gave them my information and was told I was not in their system and to just ignore the calls. I was then called again while I was out and decided to go into a branch. Again, I gave them my information and I was told I was not in their system and to just ignore it. After this I run the credit report, I find the account on there with my decimated credit score. I go back into the bank and give them my information again (hoping this was an error) and again told I don't have an account. I supply them with the account number and she's able to find it in the system. It turns out they never fully put me in the system, my social was never tied to the account. A call to their credit services number comfirms this. I'm dealt with harshly on the phone when I inquire how I am supposed to know about the account if they never notified me of it being past due and constantly deny that I have an account.

    How long are we going to put up with this? Until we close our accounts with Bank of America? They are keeping our money. Better yet, they are stealing from working class individuals. The same thing has happened to me on various occasions. I am fed up with it and I want action. We are fortunate to live in a free country and I am ready to take on the big guy Bank of America. Something needs to be done. If you are interested in filing a lawsuit against BofA, please contact me. What they do is wrong and we all know it.

    They are charging a $5 fee to cash a check from one of their business customers account if you don't have an account with them. They do not give a receipt for this fee so where is this fee going? How does the teller balance if they have collected the $5? I have asked for a receipt showing an AR code. They have handwritten them for me with no # for what fund is receiving this fee.

    There was a court order to get money out of my accounts without me knowing and the court froze my bank account for two weeks. Fine, court order I understand. But when the court order was lifted, you would expect everything to go back to normal? Not at all. I called for two weeks (seriously 10 business days everyday for 2 hours a day). Today, Feb 4th, 2009, is not different. I am literally on the phone as I am typing. My accounts still do not work. Not one person or manager is taking responsibility for me getting hung up on. Not one employee has said, "I am sorry for all of this. I will take care of your problem today." Nothing. I am finished with doing all and any business with Bank of America. Their credit cards are horrible. Their checking and banking are garbage! I am not speaking out of frustration. I am only telling the truth.

    I received an email on 2/3 stating that I will incur 4 overdraft fees even though I have sufficient funds in the bank (I have my online banking statement that I can provide). They stated that there was 1 hold for an item for $26.16 which caused this. I did not see any transaction in my account information indicating that my account was reduced because of a hold from a vendor. Unless I see that on my statement there, as far as I am concerned, there is no hold and I shouldn't be charged.

    Why would I be charged overdraft when they can clearly see that there is enough money in the account to cover the vendor and other items? If there is something reducing my balance to cause an overdraft, then it should be reflected in my statement. As far as I am concerned, I do not have definitive proof that what is claimed by Bank of America is the truth. I cannot see what they stated to be true as fact. It could have been a made up transaction to cause me to pay additional fees to pay for their bail out.

    After a few emails, chats (I have print outs), and phone calls, they refunded me $35 of the possible $140 on 2/4/09. Then I received an email that I will incur yet another fee for the same transaction that caused this whole mess. So they are taking another $70. They kept telling that this invisible hold/reduction of my balance was the whole problem. Yet, I can't see any documentation from them that states this is a fact. It's an invisible transaction that they did to take money from me and say it's an insufficient fund fee. How hard can it be that they can just give back what's mine without the invisible transaction that they claimed happened?

    I have items already posted to my account and cleared and then the items will move when I sign on again and be replaced if I have a larger amount come in to cause my account to be overdrawn, charging several account overdraft charges when if posted correctly, I might have one charged if any. I have contacted them several times about transactions being moved to benefit the bank. I have looked at my account in the same day just 20 or 30 minutes apart and items be moved around on my account.

    I have posted items in my checkbook that have cleared and have seen these transactions moved to pay a bigger item that came at the end. They have moved items on my account to place overdraft charges first. I received a letter from Bank of America saying my account was one of the ones that my information was taken from. Bank of America is abusing their customers in ways hard to see according to what answers they give. When I saw this happen on my account today, I looked to see if there were any other complaints and this was when I saw all these complaints out there on Bank of America!

    I recently paid $200 that I owed to BofA when I got my $3k tax return with no problems; money was there for me to use. I re-opened the account and was enjoying life. Then I got a lawsuit settlement and BofA will not release the funds on the date that they said they would in writing. Now they are holding it up in the risk department; over $8k every 6 months was going to come their way. Now I will stuff it under a mattress because I’m not going to let those lying cheating con-artists have my money or benefit from it in any way. I was supposed to have the money free from their normal hold on the 4th (in writing), and now they are saying the 11th. As a result, I have at least 2 checks over $700 out there to pay bills (i.e., PG&E and the Phone Company). Do they care? No, they gave me enough money to get gas to go home.

    I went into this particular branch of Bank of America this past Friday, January 30th, as I usually do every two weeks to cash my work check. I have never ever been charged a bank fee of $6.00 for cashing my checks there because I was not an account holder. All of a sudden, on this day, I was told by the teller and Ms. **, the Assistant Manager, that this was their policy and that it had always been this way. I attempted to ask the teller and Ms. ** where was this in writing for the non-customer account holders to see. I was never given a straight answer. I was sent over to speak with Ms. ** and she would not hear or listen to anything I was trying to ask her - that being, where was it in writing for the non-account customers to see we had to pay a fee for cashing a check in their bank? She never did answer that question.

    What she did do was show me on their internal computer information where it was written there, however, again my question was not answered regarding where it was in writing for the public to see - similar to the brochures they had for banking services. She refused to listen to me and interrupted me when I even tried to ask her why this was not written on any brochures similar to the ones I gestured over to with my hand as we were speaking. Her answer as to why I was charged was because either the tellers hadn't been doing their jobs or my job had been waiving the fees. This left a very bad taste in my mouth as I felt she showed very poor listening skills and was determined to get her point over to me as to why I still had to pay $6.00. I also asked her why non-account holders had to be penalized because they choose to not bank with them.

    In brief, BofA business dept. of Glendale falsely qualified me as an owner of business and suckered me into a $250.00 line of credit on my house. At the same time, they got me to refinance my house to 15 years. I told them I did not believe I had enough income at that time to make such payments. Their agents insisted that I use lien to make payments and pay off other bills. The house and lien payment monthly presently take up 70% of my gross income. After signing, they later devalued my property by 257,000 and yank line of credit.

    The point is, BofA has caused me economic hardship by falsely qualifying me as a business-owner, which I never was, with a high income without asking for business proof, and giving me an erroneous BofA business account of $1,800 (which is still open but cannot withdraw funds), just to make me look good so that their agents and the bank can reap commissions and interest by holding my house as collateral. After making mortgage and credit line payments, I have nothing left and have to live on credit cards to survive. I feel that I have good grounds for a predatory lawsuit. Please advise!

    I paid my signature online; I received a confirmation of one payment. My bank account showed two payments within 2 seconds of each. I did not receive a second confirmation; I was told that as it was their system, I could not trace it. Now I received a letter stating my signature account has been reduced to almost my balance due; add in the next month’s finance charge and it is over drawn; then there will be late fees and a higher interest rate. I have paid a higher payment this month to offset that from happening. How can they do this? They’re charging me more of an interest because they sent back the over payment I did not make. But they said until I pay a full overpay, the interest rate will reflect it as a loan because they sent the money back to me. Now, they lower the max which is just under the next month balance due!

    I have been locked out of my account innumerable times. It seems like every time I try to straighten out the situation by finding an acceptable online ID, things are changed on me. I feel very angry. I just spent the last two hours on the phone with the number given to me to straighten this out (1-800-933-6262). I cannot talk to a real person. I am on the verge of dropping out of Bank of America completely (we have several accounts) if I don't get some service soon! My account number is **. I expect to hear from you very soon. If I don't, you can cancel our accounts! I will pay my account by mail so that we do not have to communicate again if you do not call me now.

    It's my fault that I've had overdrafts and charge backs but the most recent fee resulted in a $42 overdraft. I had direct deposit that week for over $2000. The $42 fee was taken out which left me with $1972. They are in the process of closing my account so I've been told so I can't access any money. They terminated my ATM card. I was told my account is scheduled to be closed on February 11, 2009 and that they will send me a cashier's check sometime after that. This is not right. My ATM is inactivated so I can't get money there and they said they will not honor any checks that come through. So why are they holding my money?

    I can understand holding half maybe but not all of it. I've talked with branch managers and the risk management department and have gotten nowhere. I have absolutely no money at all. My utilities are going to be shut off as well as the fact that I have no money for food. I am not denying that I haven't been a good money manager lately. However, this is my money and they should not have any right to hold it so long. If I wanted to close my account, I could have that money that day. This is so terribly wrong.

    I've been a Bank of America customer for quite a while. I am going through a bad time and have been the last couple of years. They have made a lot of money off me. I am not asking for all of it right now but just enough to live on. Furthermore, my job requires that I have direct deposit. I can't open an account elsewhere because I don't have any money. I don't know what to do. I would like them to allow me to close my account today and go into a bank and pick up my check or reopen it immediately.

    I currently have a car loan with Bank of America. I purchased my vehicle in June 2004 and Bank of America was the referred financing company with the Toyota dealership. The amount financed was $26K over a 6-year duration. Approximately 1 year ago, I fell into financial hardships due to a separation. Although I was late with my payment (3-4 times, 30-34 days late), I always made my monthly payment. I asked on several occasion for them to consider refinancing my loan to lower my payment, but they said due to my late payment history they could not and it wasn't worth even filling out an application because I would be denied. In October 2008 it became even more so challenging when I stopped receiving child support income for my 7-year-old son because his dad lost his job. I tried to keep up with payments, but once you fall behind it is very difficult to play catch up.

    In December 2008 I made a payment because I knew it was 60 days past due. They told me that once I made that payment, I would be okay as long as I made a payment in January 2009. On January 22, 2008 I got a card on my front door from a man who is trying to repossess my truck! Immediately I contacted Bank of America and they told me that I'm 3 months behind! I explained that I'm aware that November 2008 and December 2008 were late, but January just became late as of January 11th, and I had made a payment on Dec. 17, 2008. They said it didn't matter because I was delinquent and my account was in repo status. The only way to stop it was to pay the full payment of $1,605 in cash at a branch and they would call off the repo.

    I had luckily received my state tax return on Wednesday, 1/28/09, and it was enough to cover it. I went and purchased a cashier's check on Thursday, 1/29/09, for the total amount due on my account which had included Nov 2008, Dec 2008, Jan 2009 and all late fees. Before I made the payment, I was concerned that even if I paid them, they would still try to take my car. So I called Bank of America repo department and requested this in writing. A girl named Rita told me that they couldn't give me anything in writing and it is just a verbal agreement. I know that doesn't hold up and I even called her out on that, but I wasn't the one holding the cards here. They were, so their rules!

    Needless to say, I paid what they told me to pay in full and I did everything as instructed. I paid the teller lady, who then gave me a receipt. Then I was told to go to someone at a desk with a phone, where I was assisted by an account specialist Keith sitting at a desk (Brea, CA Bank of America), who made the phone call in front of me to the BOA repo department (which I gave him the phone number to). Then Keith said they would immediately contact the repo people, LB Enterprises, and cancel the repo. I was assured that the repo was cancelled.

    On my way out of the bank, I called the repo company LB Enterprises at (714)-899-4000. I asked for Tony **, who was the person who left his card on my front door on Monday, 1/26/09 (who never returned any calls to me after I called several times daily and left multiple messages). I was told by a gentleman at this number that Tony wasn't available as I was always told. This unknown gentleman assured me that Bank of America had just called them and he was the one who had taken the call, and told them I made the full payment and the repo was cancelled.

    My problem? Today is Saturday, 1/31/2009, and Tony ** with LB Enterprises (the repo people) showed up at my home 20 minutes after I left for work and was sitting outside in his tow truck while my son was riding his bike with my mom outside watching. My mom approached Tony and said that he shouldn't be there. The account was paid. He was very rude and threatening to my mom, with my son right there as well. Even after the confrontation, Tony sat parked in his truck in front of our home for approximately 20 minutes.

    According to Bank of America, if I go negative in my account and transfer money from my savings the same day, I will not be charged an overdraft fee. The same day that I went negative, I transferred enough money to stay positive. Bank of America still charged me an overdraft fee. So after I transferred money, they decided to charge me $70 worth of fees which made me go negative again. This time around, I was not able to transfer funds in time, but it was due to the fact that they were charging me unfairly. So now they have taken a total of $105 out my bank account.

    By the way, this bank tries to play it off as if you get your alerts as soon as you go negative. I received my alert 3 days later. Also, I got cheated with the Keep the Change transfers that they have. They say that for the first 3 months, every time you use the card you get the %100 of the change matched by Bank of America. After the 3 months, it's 5% only. Well my first three months I used it so much that I should've had at least $50 for the first 3 months and there after I should've had a little bit more because it's only 5%. I only got $22 for the year; I had that Keep the Change Feature. Bank of America has cheated me from day 1. Thank you Bank of America for sucking so much and making me lose money in a time where the economy is so low.

    I am recently unemployed. My last paycheck was mid November 2008. Applied for and received two unemployment checks which I had direct deposited to my Wachovia account. On same day that ui payment was accepted by the bank I made a 2nd mortagage payment payment, 31 days late. They immediately claimed the remainder of the account balance and a subsequent week ui check to bring the account to a paid state for the new payment, of jan 15, 2009. Their right to recovery claim of the money created an initial deficit of $103.59 which they had the balls to chage an initial $22 overdraft fee to. Every small check we wrote prior to this knowledge of the account seizure resulted in $35.00 overdraft fees. They sweared this was an inhouse collection that they have the right to employ. $619 in the hole!!

    I am a member of the NEA. I have a credit card through this bank with the NEA. I also got a consolidated loan. I got my first bill for the loan, and it was not what I was quoted over the phone. I called and was told that there was a calculated mistake and that it was corrected. I said, "That is not my fault. I was told $186 a month and it is $260 on the bill." I was put through to someone of higher authority. She said that $186 wouldn't even have covered the loan. Again, I said not my fault. I asked if they had the tape of my conversation with the person who gave me the loan. She said “No, we only do that for learning purposes.”

    Anyway, after a long discussion, it ended up that I have to pay the $260 for the next 9 years. This is not the biggest problem. The reason I am upset is after the call; I accepted that I have to pay because I have no proof. The lady called me back and told me she has to cancel my credit card. I asked why and she said, "Because you are in financial difficulty." I said "No, I called because a quote was different from the bill." She said," Yes, but we have to stop your card." I said "Why? I have not been late with any payment, credit card, nor the consolidated bill. I don't even have a balance on the credit card!" She said, "We have to." She never gave me an answer why they have to.

    I have never been late, never anything? How can they cancel a card because I questioned a bill? Yes, I fought for the lower estimate I was given, but since I have no proof, I didn't win. Since I fought for the lower, I can only assume that they are nervous. A bank, who themselves got a bail out from the government, does this to me who hasn't even missed paying them. I would like to understand this. How can they do this when I have done nothing wrong?

    Okay i have banked with wachovia for a long time i would get overdraft fees here and there and never questioned them i just figured it took longer for something to come out i am questioning every single one i have ever recieved now... earlier this month i went to cash a check and they said i couldn't b/c my account was 337.00 negative...i was shocked...so i went home and checked my online statement..and compared it to the one they had printed out...it was crazy how totally different it was they were saying i over drafted on 8 things and on my online account it only said 2 things were...so i call customer service everyone i talked to was acting like i was crazy for not seeing i over drafted on all 8 things...on my online statement it showed where the money was taken out for 5 things and my balance was carried every time and i had the money for all items..so i went to the bank i always go to.. the tellers know my name and everything..well i had never met the bank manager vicky and i wish wouldn't of had to..i tried to explain why i didn't think i should have all those fees..like all the people i talked to in customer service she acted rude and snobby and said i clearly over drafted and i have to pay the fees..so i told her i would be back with a printout of my online statement..i came back and showed her..she acknowledged that it was showing a positive balance but it really wasn't positive(okay that makes sense)...she went through a bunch of nonsense about holds and ran around the whole issue that my account statement was just plain deceiving..i had talked to a customer service person that credited 70.00 ..well i asked her now seeing what i have been looking if she could remove more fees since it was so misleading..she said no once there is a refund done she couldn't change it....long story a little shorter i left crying...so for the next 2 weeks i went back and forth with customer service all rude and not listening to anything i was saying...in this time i talked to someone in online technical and he told me people call all the time about there online banking statements being misleading..but he could not help..so then i talked to guy named chris smith he told me he understood and that it is bank error and that he could take off 2 more fees to make my balance 197.00 i was finally relieved somewhat..i felt some sort of justice for what was being done..well i did not have my credit card with me i was going to have to wait til i got home to pay...he told me just call back and ask for him and everything would be taken care of..well it was all a lie..when i got home i called nobody seem to know who he was nothing was noted on my account..and then they went on to say my account was no longer in overdraft resolutions and it was maybe in another branch of the department..they could transfer me to customer service and they could figure it out..well they were wrong..customer service transferred me right back to overdraft resolutions who said i should just talk to my bank about the issue..well i wasn't going to do that since i would just have to talk to that manager who shouldn't even be a manager..i collected myself and said i will just call back tommorow..so i did again i got a very rude and smart mouth person in customer service who said she dosen't know why chris smith in overdraft resolutions would tell me that he could waive more fees when they shouldn't be waived in the first place so i told her i wanted to be transferred to someone else..thats when kim thompson comes in..i explained to her how i have talked to about everyone and some people understand and some don't and finally chris smith had and said he could help me but i can't get transferred back to him...she said well ms.mashburn wouldn't you think if he said that he would waive the fees he would've noted it and waived the fees on the computer? i could not believed that those words came out of her mouth and the rude snobby tone which they train there service people to use so you will just get so frustrated you pay the fees...so i told her i was not lying and that he did say that..she said she never said i was lying..even though she definitely implied it..she looked over my account and said she wasn't going to give me anymore money..i was outraged i did raise my voice saying that this was not fair that one employee could say fees could be waived and now they can't..she said she would discontinue the call if i did not calm down...which was so uncalled for since i just raised my voice out of frustration..i kept saying that i wanted to know why the fees could not be waived she said the conversation was going no anywhere because she is not waiving anymore fees..i started to get upset because i felt totally betrayed by a bank that i once trusted..she said she would try to contact this chris smith and vicky that i talked to at my bank..i was put on hold for a good 5 to 7 mins. she said she could not reach chris and again said that the fees would not be waived...i honestly think she just put me on hold and went to the bathroom...i told her i was not pleased at all with the way i have been treated and lied to..she said i just need to pay....i am now paying the fees i shouldn't pay just to close my account...it is ridiculous and what is even worse is that now i have asked around and told my story and it seems like it has happened to alot of people...everyone should pull their money from wachovia..if they haven't got you yet they will....they are not working with you they are working against you...tell everyone you know.. i have.. and if anyone knows of a lawyer that is interested in taking them on i would love to know..they would have a good case because what the bank is doing is wrong...i hope something is done so people can not be used to make the bank richer

    I had a home equity line with LaSalle Bank that was taken over by Bank of America. I never had any problems with LaSalle. Minimum payment due each month was interest only and I always paid more than billed. B of A took over and the first bill I receive is for $2083 (monthly bill was approx. $200 with LaSalle)! My next bill was for minimum payment due of $3,526! I called again, and finally, after going through a zillion menus, got through to a live person. This person stated that many people's accounts were messed up after the LaSalle takeover. I was told that the actual amount owed was $246 and that brought me current. I paid $350. This was in December.

    I was told that my account was being "pulled for review" and that I would receive a corrected statement when it was figured out and to ignore anything else I received until it was corrected. The only thing received was a general letter that I assume was sent to all of the previous LaSalle customers stating something about deferred interest billing differences between the two banks. It made no sense, because I always covered the full interest payment with LS Bank. Also, on the day of my phone call to B of A, I had someone help me get my account set up online, since I was having problems getting their website to let me register.

    By late December, I had still not received anything saying that my account had been figured out, and assuming I should have a payment due, I accessed my account online. It said, "Past due amount $0, next payment due 1/20/2009 for $171.88." I paid $200 online on 1/16/2009. I received a statement in the mail, dated 1/14/09 stating that the $171.88 was due 12/20, not 1/20, and was overdue. I never received any previous bill for that amount in the mail and my online account stated it was due 1/20, not 12/20 (I printed the current statement from the web account).

    I also received in the mail, an overdue notice dated 1/16/2009, stating that the $171.88 was 23 days past due as of that date. It also stated that I owed $73.54 in "unpaid fees", which I assumed they were trying to charge as a late fee. I called the number on the letter and got no help. I was told that I shouldn't go by the web statement because those weren't correct. I was told I should have called them to get the correct amount if I didn't receive a bill in the mail.

    Why would I think I needed to call if the web account stated $171.88 due 1/20, with nothing past due? Again, as of today, nobody has ever contacted me to let me know that my account was reviewed and fixed like I was told in the first phone call. They tried to put it on me and said that it's my problem. Somehow, I was supposed to figure it out on my own and know that what was on my web account was not correct? I have received in the mail from them to date - a bill stating minimum due was $2084, a bill stating min. due was $3526, notice from 12/12/08 stating account overdue $1756 by 18 days, a notice dated 12/13/08 stating overdue $1406 for 22 days, a notice 1/14/09 stating overdue $171.88 + $73.54 unpaid fees, overdue notice dated 1/16/2009 for $171.88 for 23 days late.

    I was rudely told on the phone that I missed a payment and when I said I was told I would be notified when it had been fixed by B of A, and was never notified or billed, I was basically told, "Too bad", and two different reps told me that the web accounts are not always right. When I inquired about the "unpaid fees", I was told that was from a deferred interest agreement I had with LaSalle?! This is what really sent me over the edge. They could not explain what it was for and said, "That's too bad - you have to pay it anyway. It was something you agreed to do with LaSalle." I have pulled my contract with LaSalle - there is nothing about deferred interest. I stated that my contract had nothing in it and was told that I still must have agreed to it so I was going to have to pay it. Now, since I am with B of A, my payoff amount is suddenly getting larger, despite paying more than my monthly interest since inception with LaSalle. Nobody knows what is going on there and I don't trust them at all.

    Bank of America holds your money. I received 6 overdraft fees of $35.00 for transactions that were done over the weekend by debit, but posted on Monday. Hmm, I have talked to 4 representatives who said as a courtesy, they would refund me $35.00. I already opened an account with Wachovia because I am sick of Bank of America and their **! This resulted in the account being overdrawn by $325.00 which means I have lost $325.00 to pay bills that need to be paid.

    On 1/14/2009, I had a pending overdraft due to an unexpected automatic withdrawal. I caught it in enough time and transferred the funds to cover the overdraft before the end of the business day. Once the funds are deposited to cover the overdraft and it turns black, then the customer isn't supposed to charge an overdraft fee. Although the negative turned black instead of staying red, Bank of America charged me $140.00 in overdraft fees. I called customer service and of course she stayed firm with her decision that it wasn't a bank error! She stated that she would not refund the money.

    Then the customer service rep asked if she could do anything else for me. I said, “Yes, give me my money back!” She said, “I can't do that.” I told her that I would be filing another complaint with the BBB as I had in the past. She said, “Do what you think is best.” I told her that I was told by someone who works for a bank that the CR's are trained to make the customer think they are incorrect about their overdraft fees. She said, “Ma'am, that isn't true.” And I just hung up the phone. This isn't the only time that my son and I have been charged incorrect fees. And yes, someone needs to put an end to this mind boggling chaos! It’s is unfair and unethical. As a result of the incorrect overdraft fees, I have had to borrow money or haven't been able to pay bills because of the overdraft fees.

    I opened a CD with $5,000 in 2003 at Bank of America and then let it roll over in 2007 at $5,552.21. I looked at it online and found it only has a balance of $1,265.76. The only thing I learned during 3 phone calls to Bank of America was it was transferred and given a check in the back office to Ann ** on 12/26/2007. I don't know this person, I gave no authorization to this person and it is a personal CD. The first call, they told me they would put a research fraud on it. The last 2 calls they denied it. The remaining balance of the CD has disappeared on 1/16/09. The bank has done nothing to rectify either withdrawals of this CD in the past 4 weeks since I reported it.

    I have no personal debts or judgments with Bank of America. I don't know what is going on. Please help me. In this economy, this is my life savings. They won’t reimburse the money until they find where it went and the trail ends with Ann **, a back office employee, cutting checks from my CD in her name. Consequences: The economic is the time put into this. The many hours of phone calls and days my husband has had to take off work. I have a nerve disease that is increased by the cold, and I had to go out in the cold weather with my husband to the bank to try to get the bank manager to help us. I experienced increased pain and symptoms for days afterwards from going out in the cold. I also have a heart condition that I have to carry nitroglycerin for chest pains; these have increased. This was my life savings for medical emergencies, etc. Now, there is nothing. There have been many of these types of incidents at Bank of America here in Florida recently.

    Very nasty, harassing debt collection agency who was repeatedly using unethical tactics to pursue a debt, such as REAGING the ACCOUNT OPENED DATE by a few years (which is most likely the date that they purchased the debt from the original creditor, WACHOVIA BANK(CHECKING ACCT OVERDRAFT FEES). This agency has reported this info the credit bureau(s) and they said the account was opened in 2007, which is a lie. I didn't have a Wachovia Bank account in 2007, but when I lived in another state (Connecticut) and that was in or about 2002/2003 the account might have been open. Also, it is past the debt statute of limitations, there is no judgement on this debt, and the fact that these agencies are making money by indulging in illegal tactics such as reaging, is disturbing!!

    My account was overdrawn in December 2008. I completed paying what I owed on Friday and Bank of America's overdraft customer service credited $140 in overdraft fees for me. On Friday, 1/23/2009, I verified that my account was in a positive status before I deposited my money. I was informed that the account held $3.97 after my deposit and the credit. I had already withdrawn the remainder of my paycheck from my Credit union savings account so that I could obtain money orders for my bills.

    Since I did not want to carry the money around with me, I decided to put it in this bank so that I could just pay my bills via check and telephone. I put in cash. I received a receipt showing my "available balance." When I tried to use the card after I made the deposit, it was declined. I called customer service. The representative I spoke with did not know why my transaction was being declined. She transferred me to the ATM card customer service line. The gentleman I spoke with informed that there was not a block on the card and suggested I go into a branch.

    I went back into the bank that I made the cash deposit. The teller did a little research and informed me that my account was on a credits only status - yet I cannot make a credit or debit purchase. I cannot withdraw money. A customer service rep at the branch phoned their customer service line and was informed that I would be able to withdraw money within 24 hours. I was told by the lady helping me that I could get the money on Saturday. I was furious because I had just made a cash deposit and I no longer owed this bank any money. I had to wait a full 24 hours!

    I tried using my debit card at a gas station - at this point, I was almost out of gas and my card was being declined at the Kroger gas station near my home. I called customer service again. The representative could not see what the issue was and again I was transferred to the ATM card customer service. The young lady I spoke with tried doing some sort of override and reset of the card but it was still being declined. I made my way back to the branch that I made my deposit the day before. I was told that the account was still on a credits only hold because I had been overdrawn for so long. So, what is this, a punishment? I no longer owe the bank. I put in cash and the bank is holding it as if it was an out of state check. I live paycheck to paycheck and I don't have anyone to borrow from!

    Why should I? I have what I need - it's just that this bank is not releasing it. I need my money! The manager was made aware of the situation and she tried whatever she tried to get me my money, but she could not do it. I was told it would be Tuesday before the money would be released to me! She had to fax in a request of some sort. Tuesday?! I'm not asking for a loan from the bank. Just give me the cash that I deposited; that is all I'm asking. I went the entire weekend without money. I had $15 in my purse and bought gas to get to work.

    Today is Tuesday, 1/27/09. At approximately 2:22 pm, I tried to withdraw money at the Bank of America ATM - as I was told it would be available today. I was declined. I went into the bank and spoke with Rekkah who called her customer service line. I was informed that I would not be able to access the money until tomorrow?! This is unacceptable. I cannot go one more day like this!

    We had an extreme drop in our income due to owning our own business in the new home service realm. We were unable to make a full payment to Bank of America so we consulted a debt settlement company for help. They told us to change our address to them and stop making payments. After 3 months, we found out that this debt settlement company had nothing to help our situation. I immediately called Bank of America and was transferred to IC Systems to set up a payment plan to take care of our debt.

    I have been a customer for over 7 years and never was even late on a payment up until Aug. 08. They had increased my interest rate to 30%. When I called them, they said only IC Systems could handle my case and they could give me no information. My husband and I have a considerable amount of debt due to our business crunch. IC offered me a settlement in which I thought I would be able to pay but after reviewing with my company advisor, I am unable to keep up with the outrageous payments. I was supposed to have my first payment taken out and I do not have the funds available.

    I wish I could settle with them but I am not able to come up with over $13,000 within the next 6 months. I have too many other debts that I need to be paying on as well. I called them to tell them that I was not able to follow through with the settlement I agreed on and that I wanted to pay off my debt in full and I wanted to set up some more affordable monthly payment plans. They said that was not acceptable and the only thing they could take would be the first settlement payment. I then again called Bank of America and they could offer me nothing as they informed me it had been sold to IC Systems.

    IC Systems keeps telling me that everything they do has to be authorized by BOA. I am sickened by the predicament that I am in but I am at the mercy of the debt collectors. I want to make good on my account but they will not make payment arrangements with me. They just threaten me with court litigation and the continuation of their constant attempts to collect a debt. IC Systems calls us non-stop, weekends, holidays, early morning, late at night. They call with unknown numbers and they do not identify themselves on the phone. They want me to identify myself before they will say who they are.

    I called 800-289-8004 and was put on hold and transfered four different times when asking for help with a hardship refinance or simple adjustment to my loan since I lost my job and need all the help I can get to keep current on all bills. Each time I was sent to talk to a different person that gave me a different spill about me not being connected to the correct department. I was then given the 888-937-1355 number and told that this number was for sure the refinance and loan dept that could definately help with the hardship issues and helping to adjust the interest and payment amounts. After 26 minnutes on this line I was finally told by a c.s rep that I could not apply for hardship and my only option was to take the loan into collection if I could not make the payment at any point. I asked to talk to a manager and he told me the same darn thing. I said let me get this right you are telling me that there is no help in adjusting the interest and payments so that I can continue to pay for the loan in the only way I know how? The manager told me that a hardship status and help other than collections did not exist.

    In mid-September of 2008, BoA blocked my $1,500 overdraft protection line and mailed out letters after the fact. This resulted in six $38 fees, however, all the OD items were paid. The explanation given to me was that BoA conducts periodic audits, which resulted in the block, and I could have my line reinstated upon request. This phony audit/block just happens to coincide with the Monday morning announcement of BoA purchase of Merrill Lynch. Apparently, I was not the only customer robbed and lied to, as the waiting time on hold for customer service was 12 minutes.

    After calling BoA for one week, I finally managed to speak to someone who told me since this was not a bank error, I would not be given any refunds for overdraft fees. Hmmm, I thought this was overdraft protection. Apparently, this is just a faucet BoA can manipulate to steal from their customers. I regret not closing my account at that time because BoA has just repeated their vile and unethical act again. They have blocked my line of credit of $1,500 without notice and I now have 11 overdraft items at $38 each. I just paid up the entire balance of my line of credit on 1/23/09, so I felt I had OD protection if I needed it. How can BoA get away with these dishonest tactics? Please help!

    I issued a check to my co-worker and it was postdated January 23, 2009. But Bank of America charged me overdraft fee. And when I asked them (I called customer service) and they told me that the check was deposited Jan. 21, 2009, I called my co-worker again she said, “No, that is not true...” She was asking me to ask the Bank of America to prove that it was deposited on January 21, 2009. But when I went to Bank of America Union City branch, I told them everything; I was expecting to reimburse my money instead. But to my disappointment, she said there's nothing they can do about it. I closed my account to Bank of America, and I called my friend again. She said they are lying! I got 2 more overdrafts charged and the same thing. Are they really going down and getting money from depositors? This is not good! You cannot trust this kind of bank to handle your money.

    I opened my account over 3 months ago. During that time, I was able to use my debit card, to write checks, make deposits and allow my job to have direct deposits sent to my account. It was joint account. My husband opened it online, and I added my information on to the account by personally going into the bank and presenting all my id. Well, back on Jan 12th my husband went into the Croydon branch to make a simple deposit. That's when the teller started giving him a hard time about ME. To add insult to injury, instead of the manager pulling my husband aside to discuss the matter of my information not being onfile. She tells the teller, who has no clue what is talking about to start talking nonsense to my husband in front of people. They started making insinuations about me, and it was truly embarassing. Everytime he asked a question the teller's response was I don't know. My husband explained to them I was a US Citizen, yet they tried to make it out like I wasn't and at that point my husband just made his deposit and left because he could not take the badgering. So I highly upset. I called my local branch in Bordentown and explained what happened. The manager at that branch apologized to me and explained that one of her worked did not enter my information in correctly. She had the manager Mary Pluncket, from the Croydon branch call me to apologize to me. Instead, Mary called me and was extermely rude, instead of admitting her mistakes and unprofessionalism, she went into this whoe speel about how I am the only one that is being singled out by Wachovia because of my first name, she was the one that was telling the teller what to tell my husband, she then instead of getting to the real issue at hand started going into issues with 9/11 and how I might not be a US citizen and that every bank should check me throughly, she does not know why they accept my business and just wouldn't stop talking, at that point, my response to her was, if I was a white person I am sure you would not treat me this way. Her response was yes. That was when I hung up on her but she was still going on and would not stop trying to get a racial/discriminative overtones across.

    On numerous occasions, I have submitted a stop payment request online to suspend an automatic check payment from my Bank of America checking account. Although the first time I called in to get assistance from a teller, I was instructed by the same teller that I could complete this transaction online in the future and even had them walk me through the instructions to do so. For one month in particular, this automatic payment was stopped an additional month for which I did not intend. When I called to inquire as to the reason, I was informed that a stop payment would stay in place until released by me. Fine! The next month that I placed a similar reversal, I was surprised to find that the bank actually released/paid a payment which was supposed to be stopped due to a prior month's reversal.

    I was told by the bank that I should not have been able to do this stop payment online and directed to small print in the online instructions which state that you must call a live rep for an ACH stop payment or be charged an additional fee. Since this had not been the verbal instructions that I had been given previously, I was somewhat surprised to find that this was now the case. I even argued that the previous stop payment had been processed online and initiated by BOA with no problem to no avail. I guess that BOA would rather collect the $400 in overdraft charges that this caused me rather than keep me as a customer and fix the obvious flaw in their system.

    My husband is overseas in Japan, went out on New Year’s Eve, and swiped his BOA check card four times. Then on the 1st of January, he swiped it another three times for sightseeing and other things. I transferred the remaining balance into my BOA account for a car payment that was coming out on the 5th of January. Uh oh, I was wrong. It was actually set up to come out of my husband's account so we were going to end up with an overdraft charge. Wrong. Somehow, the pending transactions that occurred on New Year's Eve and the day after did not actually post until after the car payment came out on the 5th so we actually incurred eight overdraft fees subsequently totaling $280. When I called to complain, an extremely exasperated representative explained that posting and pending are two different processes and as a courtesy, they would refund $42.

    Fast forward three weeks and I noticed that an unforeseen charge has come out of my business checking account and my pending transactions are going to put me into the negative. So I immediately transferred money into my business checking account and my available balance given is positive. On that note, I used my card for four more business transactions the next day. However, when I checked my online ledger, I am now in the negative because the money I transferred did not post in time, so therefore, the transactions made before and after resulted in eight more overdraft fees. Make sense?

    When I called to complain, a BOA representative told me he would credit me as a courtesy four overdraft fees ($140) thereby putting my account back into the positive so that the other four transactions would not be bounced and I would not incur more charges. Nope! The very next day, I'm right back into the negative and told this time by another BOA rep that I should be grateful that they even gave me $140 because there is a difference between pending and posting and apparently, I was not quick enough. Total fees for the month of January between my account and my husband's after the courtesy credits is $377. That's the actual cost of our car payment. Thanks, BOA!

    I have an incredible dilemma & I have nowhere to turn. Without dragging you down w/ details, let me just say the my husband, Brad, and I have worked hard for a long time to be debt free. We own a 1971 mobile home & have lived in Holly for 17 years. We raised 3 incredibly good girls who are all gainfully employed. We drive used cars & live within our means. Everything we have is paid for. With the exception of a $38,000 unsecured loan from Bank of America, we owe the world not a dime. We don't have much, but we are proud of our integrity & ability to pay our debts. A review of our (currently zero balance) credit card accounts, including the Bank of America loan, will show a flawless payment history - on time and always more than the minimum due.

    Brad owns a small welding shop in Flint & it's currently struggling, but holding its own. We were experiencing a financial slowdown and in an effort to do the right thing, I called Bank of America on January 10th (3 days before the loan payment was due) to try to negotiate a lower payment. I ended up speaking to Monica. I told her we just needed a few months to get back on our feet - I asked Monica to please see if our payment could be reduced to help us out temporarily. I was adamant that we would pay our debt.

    After asking me some questions, she told me to file bankruptcy. I was astounded! I asked her to repeat it & she said, "You need food & heat... file bankruptcy." I kept insisting that we could and would pay the loan back. She said, "No. File bankruptcy." I could not pay the January 13th payment on time, but as I knew we would, we now have the money to pay the payment.

    I emailed Bank of America yesterday (1-22-09) that I would make the January & February payments ($1200+) if the $49 late fee would be waived. I did not hear back from them yesterday. Last night, I opened our mail to discover 3 letters from Bank of America; they not only cut off our loan account, they cancelled my credit card & my husband's as well - the 2 credit cards with zero balances! The letters were dated January 10th, the same day I talked to Monica at Bank of America trying to get our payment lowered. The outrageous thing is, at that point, the January 13th payment was not even late. The decision to cut us off was based only on my phone call trying to do the right thing & negotiate a lower payment to tide us over (I need to note here that I did receive a message today that the $49 late payment fee was waived. As of this moment, I have not yet made the payment).

    Is this how decent, honest, debt paying citizens with an excellent credit history are treated? It's no wonder the banks in this country are in trouble - refusing to negotiate with a customer who pays on time even when that customer wants to pay back a debt and advising that same customer to file bankruptcy. Then, in an abrupt, prejudicial slam, they completely cut off all credit in spite of a flawless payment history and excellent credit. What, if anything, can be done about this travesty?     On 1/22/09, I was charged an overdraft fee of $35 because of a purchase in my checking account for about $15, putting me in the negative balance of $-2.60. Knowing I have overdraft protection, I had $3.05 in my savings only to find out later when I called a customer service rep. and then their supervisor that I had to have at least $50 in my savings to cover the $-2.60 in my checking. I was told that I should have read the fine print when I signed the signature card when I opened my account (in 2003) but after explaining that, I didn't sign up for overdraft protection until 2006. And after explaining to the customer service supervisor that when I asked for overdraft protection over the phone, I was not told that I needed to have at least $50 in my savings to cover any overdraft fees. I would expect a major bank like BofA to provide full disclosure before not after signing up a customer to overdraft protection. What a rip off!

    I called Bank of America to complain that they had been pulling money out of a negative account. I had been using Bank of America for the last year and never had this happen until Dec. 2008. In December, the account was negative and bill pay withdrew the amounts. I did not receive an email, print or embedded message. The same practice occurred in Jan. but this time, I received an email and electronic message on my account stating they were withdrawing from the overdrawn account. Upon trying to cancel this payment process, the website did not have an option. The banking center was closed on Sunday and MLK day. When I finally reached someone, I was made aware there was no way to stop two payments from presenting to my account on average three times. Therefore, I will be charged fees on each payment three times on a negative account.

    I have been withdrawing money with my German Card at the ATM of Bank of America for several years now. On Monday, 19th of January 2009, I tried to withdraw $900 as I usually would. Somehow, it was impossible for me to withdraw the money. After trying a few times at different ATMs, I called the German bank. I was told that $900 had been withdrawn out of my account on the same day and time when I was actually trying to withdraw it but unable to get any cash out. I figured it must be a mistake of the ATM of Bank of America. Thereafter, I went back to the branch to talk to customer service. The bank refused to assist me because I didn't have an account with Bank of America. However, when I informed my German bank what had happened, I was advised to return to Bank of America. After all that, I'm really confused and still wondering what happened to my $900.

    Bank closed my business account and all other accounts related to my name without any notice or any phone call. I asked the banker and I was told that I am overdrawn in my business account by $888,000 due to a check which I never wrote or deposited in my entire history of banking with BofA. The manager Armando helped me and told me that bank has closed my account and he suspected that some suspicious activity has happened due to which they no longer want me and anyone in my name in the bank. I told them that I need to know what I did that caused me to lose my account without any notice and they said that bank reserves the right to close my account at any time without any notice. How is this possible, when we are trusting a bank to handle our money and they do this to us without any notice or phone call, also when I don't know what I did? I have been very particular in keeping my account without any problems and I think that I deserve an explanation.

    After our bad experiences with Wachovia over the last 7 months, we decided to all move away from Wachovia so we took our business to another Bank. Meanwhile, I kept my Wachovia FREE CHECKING open to enable me to service existing debit amounts which I from time-to-time used to purchase things over the net. The plan was to keep using this account until the balance gets to ZERO after which I could then CLOSE the account. All went fine but I reached a stage where the balance got VERY LOW and when we bought things at say Winn Dixie, for small amounts UNDER $10, it would actually "allow" this transaction to go through, unwittingly for me though because I did not keep EXACT record of the balance ALL THE TIME. So after 3 or so days, I got this note/card informing me of what happened. It confirmed that $2.87 has been paid say, and then it warned me that this "transaction" cost me $35.00. I STOPPED using the card IMMEDIATELY knowing that my balance has now reached rock bottom. I would have to go and settle the balance. I did NOT get to the Bank the next day, or the next (I foresaw no problem because I was NOT using the card anymore. It was a DEBIT CARD by the way, NOT a credit card. I also had NO overdraft facility because I had NEVER applied for one, also was I NEVER aware of any existing "OVERDRAFT FACILITY" of any kind, on this account.). So I was not bothered much as I knew I just had to go in, pay the balance of about $3 + the $35 fee (because I was guilty) and close the account. A day or so later, I received more such notices, also of small amounts under $10 when we swiped the card, apparently also AFTER the first transaction which pushed the balance under zero and of course each time costing me $35. I now approached the Bank (around day 3 after the first note) with an interesting calculation on the account. The balance I swiped over 3 transactions ("unwittingly") with a valuae of under $20, charged me $35 + $35 + $35 totalling $105! Now, is this rediculous or WHAT? I stepped into Wachovia SR 84 on the day and saw the female black Manageress to explain my dismay. Ok, she wrote back the fees for the 3 transactions and explained to me why I was charged the fees and that it is my responsibility to check my balance before swiping. She also explained that the card would be DENIED/REFUSED if there was a zero balance upon offering the card in the first place. I was happy to know the workings of the card and KNOWING that I was NOT using it any further, I waited for my account to arrive where I could see the amount she wrote back and I would go and CLOSE the account. I was now quite sure that all my swipes had gone through and understanding what this Manageress had told me, nothing "more" would happen on the account. What a complete ILLUSION I was under because when I now received a balance notice, it reflected a "BALANCE" of $236 OVERDRAWN!!!!! How this could have happened, I do not know and I think Wachovia does not know either. I was NEVER phoned to enquire or to seek authorisation for any such transaction, neither did I at ANY time apply for ANY overdraft facility. The information that the Manageress gave me on the day I visited the Bank, was completely WRONG. I have NOT been using the card since that first "overdraft" little balance of $2.87. So at the moment, I am anxiously waiting for the full monthly statement to verify my suspicions and meanwhile, I thought communicating my frustrations with you and possibly warn other people of Wachovia's actions, would be in order. I have not yet been in to finalise the matter with Wachovia but it is happening soon. Your comment will be appreciated though. I feel the actions of Wachovia are totally wrong and it's handling/administration of such accounts are completely irresponsible and out of touch with consumer interests.

    My husband and I opened a joint account with them. It has been almost a year. The bank was previously owned by a different company and had never had any problems. Unfortunately, the branch was purchased by Bank of America. Needless to say, we decided to do a direct deposit account. Well, a situation arose that our account mysteriously had started being overdrawn and was showing a significant withdrawal from a local ATM. Mind you, this was done on a day where my husband and I never left our home and from an ATM that we had never been to nor could the customer service rep tell us where the ATM was located.

    I contacted the bank hoping for some resolve. After being transferred seven times and being told that each person could not help me, I was finally transferred to the claims dept. Well, after speaking with a rep there and becoming very frustrated at this point, I finally spoke with a rep that assured me that they would help me. After spending, no kidding, almost 3 hours on the phone, I was then told that the charges would be overturned. The funds were returned to the account. We were told that it may be temporary, however was assured that we would get an affidavit of fraud and that once this was received that the situation should be taken care.

    Having some legal knowledge, once the affidavit was received, though it did not state that it had to be done, my husband and I completed the form and realizing that this is a legal document decided to have the form notarized which was returned to claims via fax and confirmed received by the claims dept as well. We were also told by the rep that there would be an investigation into our claim and we would receive paperwork with the outcome of the investigation(?). Well, in the process of filing our claim, we ended up moving to a different address. Mind you, we did notify the bank as well as the claims dept. of the address change, seeing how we had not received any paperwork concerning the investigation and did not want to miss the opportunity of reviewing the results of this so-called investigation.

    This claim has been filed mind you in Dec. The bank had been notified of our move in Nov. Well, to make a long story short, we did not receive any paperwork as promised. When I contacted the claims dept, Jose who was supposed to be a supervisor claimed they never received the address change. They then stated they received it but it was in Dec. which was not true. Then to make matters worse, we had some payments that had to be made. Like anyone who has direct deposit, we were expecting the funds to be there. Why not? It was almost payday and without our knowing the so-called temp refund was overturned. No funds in the account.

    And wouldn't you know it, not only did they place our account in the negative, but we are charged several overdraft fees in the process. After speaking with the rep Jose, I was told to file a police report and that they would resubmit the claim for review. However, given the fact that we did everything that they told us to do regarding our claim and the fact they have not done anything that they said they would up until this point, I seriously doubt that it will be resolved correctly on their end. I told my husband the situation and planned to file a police report, and if need be pursue it legally as well.

    Because when people go to work, they expect a check for their hard work and be able to pay their bills. What they don't expect is that when they need their money, the same bank that they have entrusted with their funds is going to overturn deposit with no funds and charge you an overdraft fee for them overturning a deposit with no notice. If anything, I would say that Bank of America is a prime example as to why most people do not trust banks with their money and would opt to receive a paper check. After this experience, I think it's safe to say who really needs to be investigated for fraud.

    I've been a Bank of America account holder for a few years now. The first accounts I had with Bank of America, I had an identity theft problem that I had reported and immediately closed the account. I opened a new account and thought all was fine. Besides the occasional problems with overdrafts due to their check hold process, I haven't had any real problems. I even opted to have my paycheck directly deposited into my account. Then, my wife does what she usually does every paycheck Friday - pays bills and runs miscellaneous errors while I'm at work. However, the next day, there is an unauthorized amount of $32.90 that was taken out. It did not make the account go into the negative, but it did say "debit/hold" as opposed to the company or location, like usual when you check your account with online banking. So, that was a concern and I contacted Bank of America. I was told there wasn't anything to do until the transaction posted - Monday night. If it was unauthorized, then it would be refunded.

    Well, I continued to use my bank account normally, make more transactions when needed, knowing my balance. But Monday came and my account ended up in the negatives by about $10. I immediately called BOA, and they had said it was because the $32.90 posted above all else, and all other transactions were put in largest to smallest order. What was the $32.90? Well, it was from the closed account with a negative balance. Yes, the one I had closed for identify theft. The customer service representative said that they sent papers that needed to be filed within 60 days and were not, so the $600 identify theft problem was mine now. I have lived at the same residence and never received any papers. When it happened, they had stated everything would be taken care of. But now it was too late. There was nothing to be done about the $600 or the $32.90.

    They stated that because of the negative account, they could take money out of my account any time it had a positive balance until the debt was paid off in full. Yes, it is legal. And no, I can't do anything about it except find a new bank - which they politely informed me would be hard to do unless I paid the $600 because it would be on my credit. To make matters worse, the way they put the order of my transactions - I received six, yes, six overdraft fees of $35 for a total of $210. When I called to ask why I received all the overdraft fees for the $35 when my account had funds, they had said they do not put the transactions in the computer by date, but by amount. They never went into specifics about this, but the funds were not refundable, and "You have to keep track of your transactions to avoid this again."

    The extra $210 had to come out of my direct deposited that I could not cancel before the next pay period. I cancelled my direct deposited and opted to cash my check in a check cashing store until I paid off this $600 for a new account. However, I received a $100 personal check during the holidays and had to use my Bank of America account. I decided to deposit the check and transfer $90 over to my PayPal account immediately and had used $10 for gas. However, during the pending period for the PayPal (3-5 business days unfortunately), BOA imposed a $4.95 monthly fee - the first time I had ever received this since my savings account ($3 monthly fee) was transferred to a second checking months ago. I had never received any monthly fees since the savings.

    The $4.95 made the account go into the negative, of course. However, I received the two overdraft fees and the money was never transferred to my PayPal account because of insufficient funds. Therefore, subtracting the $70 for overdraft, the $10 for gas, and the $4.95 in “monthly fee”; my $100 was now $15.05. Needless to say, I have since closed my BOA accounts and received a new bank account even with the $600 on my credit. I will never use Bank of America again, and everyone should be warned about this.

    Wachovia sucks we should sue then for charging so many overdraft fees when the mney is in the accounts, and now i call and even the debit transactions supposly them they are on hold as well. Why in the world do we have a pin number then and why is a call debit instead of credit. I am so tired of paying them overdraft fee, i feel like i work to make WACHOVIA richer. This is incredible, we or to be be able to pay our bills etc and with this is impossible. We have to do something.

    I needed a letter confirming a payment via Bill Payer to a vendor for my condo association account. I walked into a BOA branch and they said they were unable to do it at the branch and I needed to call customer service. I came home and called the phone number I was given (800-831-4419). The offices were closed. I then came online and found the regular customer support and called. They could not help me because they were closing in four minutes, and my expected wait time was seven minutes. The agent (Tanya) was very polite and understanding of my frustration, but was unable to do anything about it. The really irritating bit is that whenever I come into a BOA branch, a friendly customer service rep gently nudges me to transfer my personal account there. I smile and decline. Hope the above incident, one of many, explains why.

    The new 24-hour ATM deposits have to be made by the electronic reading of the check via the ATM. I was not able to get to the bank during business hours, but surely I thought I'd be able to make a simple deposit. I tried 3 different branches and the machines would not accept a perfectly good check in good condition. There are no after hours deposits unless the machine works. All the metal night drop boxes are locked shut. This is an unacceptable way to do business. You have no options for after hours deposits unless the machines work or you mail the deposits to the bank. What a joke! Before they made this new change and stated deposits are now easier, it was easy to make a deposit. This is terrible customer service. Yes, it is easier for them but not the consumer. It is all about what is convenient for the bank, not the customers.

    Honorable Congressman Gus Bilirakis:
    I am sending this letter to inform you of the banking situation that I have with Wachovia Bank. I have requested that the above checking account be closed. We are not happy with the services they are offering. We Wachovia will not close the account because of the negative balance of $679.76 which happens to be because of NSF. The amount due of fees that your bank has charged for NSF for the same items over and over is horrible. I can not believe that the bank would continue to charge NSF fees for the same item over and over again. I had called and advised customer service that those items should not be paid. However nothing was done, except the charges of NSF. We have decided to go with a financial institution that better suits our needs. We have decided to keep our accounts with Bank of America. At least at BA they pay they item as well as charge you the NSR fees. In that case it is worth it. However just having a negative balance of over $600.00 for NSF is not fair. I GraceSinda Duran have been unemployed for over 1 year and can not afford to pay the bank over $600.00 in NSF fees. My husband is disabled and we live on Social Security only because I can not find a job. We have not be able to pay our mortgage for several months now due to my unemployment, so how am I to pay this negative balance of only NSF. I decided to write to you to let you know how unfair and unjust this is and how we the government should not assist the Banking Community with any of there problems since they are not willing to help the small people in time of need. I would appreciate it if you can bring this to the Banking Commission and let them know how unfair Wachovia Bank is and how they do not care about the little people and there needs. People are losing jobs, their homes and banks expect people to pay NSF fees over $600.00. How fair is this? In order for this account to be closed it most be brought to zero. We can not pay the Bank over $600.00 in NSF. We are having a hard time paying the mortgage, paying the electric and now having to pay this high NSF. I wanted you to be aware of this situation and that I have also decided to take this to the media for assistance. Wachovia has contacted me and advised me that the account can not be closed until brought to a zero balance as well as if not done within a certain about of time it will be reported to the credit bureaus as well as ChexSystem. This is not fair!!!!! They are not willing to help us. We thank you for your time and understanding in this matter. We look forward to hearing from you soon.     I have banked with Bank of America for several years and have had a few problems but this one tops them all. I checked into my online banking to discover that I had been charged two overdraft fees. I found this very strange since I had not overdrafted my account. At one point, my account was very low, but it never went into the negative. So I logged into the live chat feature to talk with a customer service representative. I was told that the account had two temporary holds placed on it from two debit card purchases. This is an extra temporary charge that a merchant puts through just to ensure that there are sufficient funds in the account. These charges are then refunded to my account.

    So these temporary refunded charges had my available balance in the negative. My actual balance was not in the negative. While the available balance was negative, two other small transactions cleared. These two new transactions did not put my actual balance in the negative, but since the available balance was negative, I was charged $70. I asked if there was any way to prevent this in the future. There is no way for me to know if these holds have been placed on my account and I would rather have my card declined than be charged $70 for less than $20 of purchases. I was unable to obtain any help in this regard or get my fees refunded.

    I have 2 checking and 1 saving accounts. I have been with Bank of America for 10 yrs. I checked my account and had some pending transactions on 01/04/2009 which my account had enough money to cover. On the 6th of Jan., a check posted from Bill Pay that overdrew my account. Bank of America waited to post my pending transactions until the check posted and then decided to draft the rest charging me 5 times $35 overdraft fee. They never gave me a chance to put or transfer any money to it. I never agreed for them to pay bills without any money being in the account. This bank is legally stealing money from their customers. I have checked the regulations with the FTC on banking and it states in there that a bank has to give me the chance to put money in or decline a payment. None of this is happening. I'm putting in a complaint with BBB and FTC. Also, I will forward this to the state attorney's office. Someone has to have a way to stop them.

    Wachovia Bank has habitually and illegally responded to bogus legal documents issued by debt collection agencies. When called to task about the matter, and provided with legitimate information proving, for example, that the garnishment was inappropriate and against Pennsylvania Law, Wachovia releases the hold, but debits a $100 fee from my account.
    The only funds that I have in the world are Social Security Disability. It is directly deposited into my account once per month. The funds are indicated and designated as such. This information is available to Wachovia's Liens & Garnishment Department, managed by Ms Gormley. They instructed me to keep them informed of my disability status, which I have done, but the direct deposit from SSD is also obvious to Wachovia. They have the ability to access this information and not respond to the bogus liens. Instead Wachovia sees an opportunity to gain $100.00 from its consumers by putting a hold on the bank account. When I contact the debt collector and inform them that the funds are SSD, and the I am a resident Pennsylvania, they immediately contact Wachovia and direct them to release the hold. Wachovia does so, but fails to return $100 of my SSD. Wachovia willfully aided and abetted an illegal act. Even the collection agency trying to collect a bogus debt, is aware of the law in Pennsylvania as it relates to the legal protections surrounding Social Security Disability. They are not interested in having me issue a complaint with the Federal Trade Commission, and for this reason they submitted the release to Wachovia. Although my Social Security is directly deposited into my Wachovia checking account, and is designated as such, and available for varification and confirmation via Wachovia's own CBI screen, Wachovia agent Megan informed me that they are too busy to check the system to confirm that a garnishment request is bogus and illegal, and that the consumer's monies are SSD. An individual at the collection agency with whom I have no relationship and owe no money, informed me that he previously worked for a banking institution and that accessing disability information about an account holder is quite simple and takes no time at all. Apparently Megan of Wachovia had more important things to do then to service a long-term customer. Wachovia refuses to release the $100 fee that they charged me, and they are breaking the law in the process. It then begs the question, how much money has Wachovia bank earned by merely breaking Pennsylvania law and knowingly defrauding others?

    Bank of America charged me an overdraft charge ($35), but according to my online banking ledger my account never went negative. I called to clear this up. Tammy from Rio Rancho contact center told me that what I saw on online banking does not reflect the money that is actually in the account. Thus, while my account never went negative according to my online accounts, BOA said from their end it did. Tammy was dismissive, disrespectful and frustrated when I didn't understand. I believe BOA is playing with my funds (preventing items from posting on the day or day after they were charged) and is holding money until my balance is low enough to drop the items all at once and incur overdraft charges. Since opening accounts with BOA in June, I have received roughly 25 overdraft charges - many of which posted in clusters or overnight so that I could not protect myself.

    A customer of 28 years, I have checking, savings and credit card accounts at BofA. I have usually experienced quite helpful (sounding) service with its agents. In structuring the account spread, I have three times in recent memory attempted to link one of the cards as backup to the checking account. Both times, I was told it wasn't but it is now both at a branch and on the phone. In Dec. '07, I received a postcard stating an NSF transaction, paid and charge to my account of $35. I went to the local branch to have it sorted. The surly operative said, "No, it is not linked and there's nothing I can do about the charge." What? I proactively established this, so I thought, and verified/corrected it at my semi-annual checkup and it doesn't work. Then why was I told it would? As if some joke, half of the notice card is a return not prepaid but requiring one's own stamp with check boxes: I have overdraft protection through my savings account. I have overdraft protection with a credit card and two others re: alerts.

    Why is this bank asking if we have such protection when it obviously does not work? Might this survey simply be a scheme by which to obfuscate the bank's own device to scam, under false pretense of having offered a service, the customer out of the fee while pretending either a) not to know of the customer's election for the service or b) that the service is, or should be, in effect for the account but something seems to be wrong with the bank's records/system in either event netting BofA some quick extra cash? Any small business pulling such a stunt would be likely done for misrepresentation or fraud by Cal DCA. (Oh, you did sign up for our special coverage? Too bad it didn't work, sucker.) I'm going to the authorities over it next.

    My aunt was the victim of identity theft during the month of May 2007. She was residing in an assisted living facility in Pennsylvania at the time that her Bank of America checking account was compromised. What basically took place was this: someone removed three checks from her checkbook and attempted to cash them. The first attempt was successful, the other two were not. The amount of the check cashed was $35,000 at a Citibank location in Manhattan. This check at the time it was cashed had fraudulent signatures on both front and back, and no thumbprint or driver's license number was on the check anywhere. I have never been told as to how this check circumvented the bells and whistles that are supposed to be in place to prevent such a thing from happening.

    I filed a claim with Bank of America to try and retrieve the stolen funds immediately after the theft was discovered at the end of September 2007. Because the theft was not reported within sixty days after the fact, Bank of America respectfully denied the claim. At the time, the theft was discovered my aunt was recovering from surgery, both of her legs had been amputated a week prior due to her diabetes. She was also showing signs of dementia during the summer of that year. My aunt's lawyer was immediately contacted and notified, and proceedings began against both Bank of America and the assisted living facility where my aunt resided. I was told by the lawyer involved that he felt confident of an out-of-court settlement, but now a third party defendant has been dragged into the case, this more than a year after legal action was initiated.

    My aunt had no children, no family at all with the exception of myself. She lived in Pennsylvania, I live in Michigan. My aunt's health was very problematic at the time of the theft, her suffering from diabetes combined with the onset of dementia made it impossible for her to understand or deal with what had taken place. Bank of America needs to acknowledge this and respond appropriately. My aunt died the end of October 2008. What assets she did have were turned over to the nursing home where she lived until the time of her death. It is now up to me to pursue this action to its eventual outcome.

    Bank of America has refused to send me lost statements or, what I finally discovered was that they sent my November and December statements to me after I withdrew several hundred thousand dollars to another two banks. It took 60 plus emails and I still have not received duplicates of my statements. They did promise they would be coming and I have not received them. I since have inherited a great deal of money in the millions in trust and they are the last people I would consider dealing with anything other than a checking account. I proved they were missing $134,646 from my account when I changed to two banks who backed me in not getting information from BofA. They treat you like crap even if you have had as much as a half million sitting in their banks while deciding how to invest. I am warning people against dealing with their power plays.

    My issue with BOA is their apparently random policy of placing holds on deposits. I have a rental property, which I have received checks from the renter for 14 months. Until 4 months ago, everything was fine. I would deposit it in the ATM and it would be credited about 24 hours later, which is fine. They installed those new ATMs that scan the checks and then they started placing holds on the deposits before placing the credit. For example, if you have $500 and deposit $1,000, your balance would show -$500.00! This caused numerous overdraft fees, etc. I talked to someone at the branch in Irving, Texas on MacArthur Drive and he released the hold. He told me to not use the ATM to deposit any more because this had been happening to people.

    So this month I made the deposit with a teller, as suggested. The money showed up in the available balance 24 hours later, so I paid about $400 in bills. Later that same day, which was 1/9 (Friday), they placed a hold on the deposit and pulled the money out of the available balance. I know the renter very well and I stopped by to ask him about the check he had written me. He showed me online. His bank account had over $18K in it! So why is BOA placing holds on accounts? For the fees, of course. I went to the bank in Plano at Independence and Custer and spoke to the Branch Manager. He said he may release the hold on Monday. If they don't, I'm closing my 3 accounts and moving somewhere else. No one at this bank gives a crap about the customer!

    My father passed away in July 2008 but three months prior, I started assisting him with paying off as many bills as possible. To the surprise of my brother, mother and I, he had requested and received a $30K loan with BOA. When I went to the branch that he used, the branch manager informed my mother and I that he applied for the loan in August 2007 and that no member of our family had co-signed nor did he sign a document in the event of.

    Since providing BOA with death cert and the newspaper announcement, they insisted that my mother (age 73) is responsible for the debt or a lien will be placed on her home. Yet, BOA will not provide us with a copy of the signed contract and the interest is still incurring. What recourse does my mother have? I've checked every website trying to find a state of Maryland statue on this. BOA branch manager at the New Hampshire avenue location has not been kind but she is only doing her job for her employer. Could someone provide any assistance or information to me?

    I am reading about all the BOA reviews concerning overdraft fees. Well, first of all, they try their hardest not to credit these fees back to us. You would think that they would want to help the average long term customer, especially in these hard times. Well, think again. I have a friend who works for BOA and on their computer screen, there is a section that pops up on their customer information screen and it says: Retention Score - for most people, the score is low regardless if you have been a customer for a week or twenty years.

    It is all about how much money you have invested with them and how much money they are making. If you have under $10k at any given time, your score will be low. They get nasty and rude and when you try to complain and talk to a supervisor, they are even worse. It does not matter. All they do is look at Retention Score and they can say/do just about anything they want to. This is great customer service.

    I have several accounts with them, and they charged me 4 ODs. When I called them, the supervisor, was so rude that I told her I wanted all my accounts closed. She then replied, "Sure, no problem." Well, long story short, after closing the personal accounts, I then proceeded to put my fiance on the phone to close our joint account. She (supervisor) told my fiance the same thing (no problem). But then is when it got kind of funny. When my fiance then told her she also wanted to close her business account, she was told they did not see one. That was because it was under business and that's where we kept most of our money. That's when something must have been seen, because the supervisor started to backtrack. She was apologizing and trying to keep us from closing the accounts. This was a Saturday, and Monday morning we had someone from BOA call us literally begging us to stay.

    We have moved our business account to Wachovia and I am very happy with them. We did keep one account with BOA, but I am very careful with anything I do with them. My advice to anyone who has a BOA account, switch banks if you can. You will see a difference in customer service with another bank (especially Wachovia).

    I was called by BofA for an unsecured loan of $50K with no balance transfer fees and a rate of 5.9%. I applied and was turned down. Four months later, I got a bill from BofA for a loan of $52k at a rate of 15.99%. I never approved this loan nor would I ever approve such a loan. I called BofA and they had no answer for me only that I was obligated to pay the loan back at the rate they gave me and to pay the $2,000 in transaction fees they charged. I asked for a signed application approving that rate of which they could not provide to me because it doesn't exist. What do I do? BofA paid down my AX card and then AX in turn lowered my credit limit from $56k to $6k because of the high rate BofA is charging on my unsecured loan I never approved. I did not make the first payment.

    At the end of July, I was going to do an electronic funds transfer to another person of $12,500.00 to their Bank of America account. The funds were not available so I was charged for non-sufficient funds on 7/25/08. I talked to a customer service representative on the telephone and told them I understood and wanted to make sure they would not transfer the money again, and I would be charged for another bounced check. They did try to run it again but refunded the money on 7/29/08. This is the last I thought of it until 9/8/08, when Bank of America took $12,500.00 out of another account I had under the same tax ID number because they said they had paid the transfer from July. I could have understood if it was a couple of days but 1.5 months later seems extreme since nothing showed as overdrawn even on statements.

    I contacted customer service and asked them at this time who I could report this to. The lady on the phone told me that Bank of America is a private company and does not answer to anyone. There is nothing I could do about them taking the money and they are keeping it.

    Just like all the other people who've complained about BoA, I'm also one of their overdraft fee victims. I have been battling BoA since 1-05-09 in regards to this issue and today is 1-09-09. I keep getting the "It's your fault" statement, keep a register, and them explaining how overdraft fees occur. Okay well, I'm an educated person. I know how overdraft fees are incurred and don't need an explanation. I simply asked them numerous times, "Why does my online bank statement only show 6 transactions that have caused my account to become overdrawn and I have 11 overdraft charges?" They cannot answer that one simple question for me. Like everyone else, I have contacted the wonderful helpful people at customer service and they only point fingers, belittle you and tell you oh well, it's not their fault. They don't take the time to answer your question. They automatically assume it's your fault and them charging you is right.

    Well, I think they must have a class of how to be rude and condescending to customers because everyone who has answered email, everyone I've talked to on the phone and even the manager at my local branch are rude, unhelpful and just plain ugly! No one via email, phone or in person can answer that one question for me. I have email alerts that say the overdrafts occurred a day after they charged me overdraft charges. They stated my first 5, yeah 5, overdraft fees were due to transactions that occurred on 1-5-09, yet in my email alerts, it specifically states those overdrafts occurred on 1-06-09. On 1-05-09 online statement I have, my account is not overdrawn. So on 1-06-09, I logged on and saw that my account was overdrawn by $142.21. So I immediately went to the bank and deposited $300, which at the end of the day, I received an email alert saying my account balance was low, after depositing $300 and only being overdrawn $142.21. Hence, all five overdraft fees were taken from my account on 1-06-09 for so called overdrafts that occurred on 1-5-09, but didn't show on my online statement.

    So on 1-07-09, I checked my balance online and my account is overdrawn now by $41.10. So my husband went to our local bank and talked to the manager who stated that the transactions that caused the five overdraft fees occurred on 1-5-09 regardless of what the online bank statement showed. So my husband fought with him for a while and then he asked him if he went and deposited money into the account right now because it's overdrawn $41.10, would he still be charged overdraft fees? The manager said yes. So it doesn't matter if you deposit money into the account or not, they're still going to charge you overdraft charges. And with regards to customer service telling you to do the email alerts, I never got any email alerts on 1-05-09 showing my account was overdrawn. I got one on 1-06-09 showing the transactions that had gone through and caused my account to be overdrawn. The manager also printed out a transaction history which showed what the online banking statement shows you and what the actual bank sees themselves.

    Let me tell you it's two different amounts. The online banking showed we were in the positives and what the bank goes by to charge you overdrafts showed we were in the negatives. How can they go by something different than what they're showing the customer? Is it not our account? Is it not our money? We should be able to see what they see so we can stop those overdraft fees from happening. On 1-06-09, I was charged 5 overdraft fees on 1-07-09. I had three more things pending on my account that once again threw my account into overdraft. On 1-08-09, three more overdraft fees were charged to my account. Today, 1-09-09, I have three more overdraft fees which threw my account even farther into overdraft and two pending transactions (one which is their charge of $8.99 for some privacy assist crap I don't use) which will incur two more overdraft charges of $35. They just haven't put them pending to my account yet. So my account as of today is overdrawn by $317 after depositing $300 three days ago which would have covered all the transactions minus the overdraft fees.

    As of today, 1-09-09, they have charged me 11 overdraft fees, credited on overdraft fee which leaves me with 10 overdraft fees that total up to $350 and that's not including the two overdraft fees I'm going to be charged for the two pending transactions. This is a bit ridiculous. There should be somewhere else we can go with these issues. I simply want to know how they can show the customer one balance online but they go by some other balance secretly and charge you overdraft fees. I have a copy of the transaction history the manager printed out and if everyone saw it, they'd be going to lawyers ASAP! I have copies of my online bank statements everyday from 1-02-09 and emails, and the transaction history that came from the bank so maybe someone, somewhere can help me get my money back. I don't mind paying for the items that shows on my online statement, that threw my account into overdraft but I am not paying for some bogus crap they go by unbeknownst to me!

    On Saturday (January 3, 2009) I went into the BOA on Ridge/Congress Road and made a cash deposit. I used my ATM card later that day at 2 separate stores - one was a $64.00 transaction and the other was a $2.67 transaction. The next day Sunday 1/4/09 I was texted from my cell phone carrier that my bill was due. I went online and paid that. Monday comes and it shows a minus fee on my bank statement, which I had no problem with. I would pay the overdraft fee figuring that all other transactions were done. On Wednesday 1/7/09 I checked again and it was still showing the same amount that was at a minus on Monday. Thursday 1/8/09 I went and put money in to cover the amount and to put extra in to cover an automatic payment for Friday 1/9/09.

    I checked my account when I returned from the bank, only to find that the 2 transactions from Saturday 1/3/09 and 2 overdraft fees in the amount of $35.00 each were posted and there went the money I put in for the automatic payment for Friday. When I called them Friday to decline the automatic payment that was to come out, they told me there was a $30.00 fee. Now I have another $35.00 overdraft along with the automatic payment coming out. I was unaware that a cash deposit on a Saturday would not post till Monday as they told me they do not have to tell all customers that when they make a deposit on Saturday. I asked them, “Do you really think I would use my card for a $2.00 transaction, only to be charged $35.00 if I knew this would happen?” Also that all transactions do not get posted till Monday. So they did not go in the order that the transactions were done and took out the highest of the three transactions first (the last one before the other 2 in order to take 3 overdraft fees instead of just the one).

    On 1/08/09, at approximately 8:30 pm, I noticed through my Bank of America online banking account that I was being charged an overdraft fee in the amount of $35 for a personal check, which I issued to be paid on 1/07/09. The check was accepted by Citibank on 1/05/09 and cashed by Bank of America on 1/06/09. I explained the situation to the customer service supervisor named Jamie who failed to provide me with a last name, who states that the bank takes no responsibility for cashing a postdated check and that the responsibility is mine to make sure that the party I issue a check to does not cash such check before the date issued.

    I deposited a money order on 1-2-09. I specifically asked the teller if there would be a hold on it - because they put holds on everything. I was told there would be no hold on the deposit. I checked online later that afternoon and the money was in my acct. Needless to say, I wrote a couple checks and used my debit card that weekend. Monday morning when I checked online, they took the money out of my acct on Saturday and put a hold on the deposit. I called the customer service phone # and I was told to go to the office where I made the deposit. I did, and the lady that helped me was very nice (this is the only person that was nice to me). She tried to find out why the money order was put on hold. They would not give her answer why it was credited to my acct. and then taken out.

    Fast forward to today (1-8-09), I have had $280.00 in overdraft charges that I feel my acct. should not have been charged. I called the customer service # after they released the money and I was informed that it was not a bank error and they would not credit the charges I incurred. She suggested I go back to the bank to see if they could help me. The lady who helped me in the beginning spoke to her manager and I was told they could only credit back $100.00. I was not happy with that answer, so she went back to her office and then came back and told me they could only credit $210 of the $280 they charged me because I had pending charges after the deposit was made and there wasn't enough $ in my acct. to cover them. Now, if you look online, the $ was there.

    Bank of America has terrible customer service. They always find a way to charge you with whatever fees they deem necessary. After all my charges are run through my acct., they will no longer be my bank.

    I deposited a $5,900 check into my checking account on 12/18/08; a hold was placed on my account till 12/26/08. I was allowed to overdraw my account accumulating 4 $35 OD charges. I went into the bank on 12/23/08 which is when I learned of the 4 OD fees. The bank manager as a courtesy released $600 in funds and informed me of the 4 charges, stating that there was nothing he could do to reverse the fees. As it turns out, I looked at my account a few days later to learn that there are now a total of 10 OD fees for a total of $350. Where did the other 6 come from? They are not willing to reverse the fees for me or explain where the 10 transactions came from that caused my account to be overdrawn. My bank statements do not show a negative balance, neither online or the paper version.

    I am extremely upset at being robbed of $350 from an institution that I trusted with my large deposit only to find out in the end they have no intention of helping me in this matter. I have been told several different things by different BofA employees as far as how to keep track of my account balance. I was told not to use the online banking for a correct balance. I was also told not to use the statements I receive from the ATMs. I was sent a check register by a BofA supervisor and told to use that.

    On January 7, I contacted BOA to request a lower interest rate on an unsecured line of credit. This is something I have been trying to negotiate since February 2008. They refused me in the past stating that I have too much credit (the bulk of which is the unsecured loan), and that the only offer they had was an equity line. It almost went through as I had a closing date, but at the last minute I cancelled the closing.

    This time, due to further reduced interest rates and my job, I requested that they reconsider. Denise referred me to a Debt Management company that they work with, with telephone number 1-877-357-6309. I told her that I did not want a negative reflection on my credit and that this would show negatively; it’s just the same as filing bankruptcy, and that was why I was trying to negotiate with her. I begged and asked her not to do this as it will be detrimental to my credit score. She said that she was protecting her bank. I asked her how have I been irresponsible with any of my accounts, and she said that it was her opinion upon review of my accounts that she based this on. I had over $2,000 in my checking accounts at that time.

    She said that based on my statements about bankruptcy, she closed all my accounts, all four of them, two of which have a 0 balance and one of them with only $1,000 out of a $7,000 credit line. The only high one was my unsecured credit line which I have been paying $500 every month since 2007. This has now eliminated my debt ratio and lowered my credit score to the point I can now no longer apply for a refinance on my home.

    I have been noticing small amounts of up to $100 missing from my checking account here and there. What really got me was that I had just balanced my checkbook, viewed my online statement and it matched perfectly with the bank's number. Well that same day, after 5 pm, I went to take out $100 and my account was short $50! I was like, “How could that be?” So, I called their 1-800# and got a representative on the phone. All they could tell me is that it must be the way I am balancing my checkbook. I asked how this could be when I just balanced it and it matched with what they had. They said something about it probably not clearing yet, and I said nope, that is not it. I also told this representative that this is not the first time this has happened. This is not the first time they kept blaming my math abilities.

    Needless to say, I hung up the phone and went into a branch office to complain as well. The representative in the bank stated that he could not do anything because I didn't have evidence of what I saw online and what I got from the ATM printout were different (yes, that was my fault, I thought to myself, but why do I need to make print offs?). Well, needless to say, I have been out of $50 - $100 at random times and cannot get my money back. It has not happened since October, but it happens in 4 -6 month increments. So, whoever is doing this or whatever is happening, they know what they are doing because of when the money is being taken out. It’s just enough to not raise any flags, but only with the unsuspecting BOA customers. And then, they’re being made to look like fools when they complain. I am continuing to have $50 - $100 missing from my account in random months. When that money is being dependent upon to make sure my bills are paid, I had to cut things because I don't account for the money to come up missing.

    I live on my SS income of around $700 a month and have banked at Wachovia for at least ten years.
    My tale is the same as those that others have told. I keep all my banking records in an Excel spreadsheet with dates when deposits and payments are made, amounts, and dates when the bank takes the money from my account. I also keep a close watch on my account activity at the Wachovia site. On Monday evening, January 5, I checked my bank balance, which was $224.59, and looked to see what bills had been paid. (I do all of my banking online so rely heavily on the Wachovia internet site to know what's been paid and what hasn't.) I had only two outstanding bills that I knew I owed, $215.98 for my car payment, and a small $4.95 purchase, which showed up on "Hold". That would leave me with only $2.86 in my account, but it was still a positive number. To my distress I also saw a "Hold" on $12.95 for something I'd entirely forgotten. So I grabbed $20 and rushed off to the bank, where I deposited the cash at 7:28PM into the ATM attached to my branch. Even got a receipt. When I came home, I checked, and the site showed the $20.00 deposit processing, but most importantly, no other charges had appeared while I was out. The two small bills, for $4.95 and $12.95, were still on the "Hold" screen, and the car payment hadn't appeared. I'd been told several months ago that posting occurred around midnight, so I figured I was safe from being overdrawn. (I haven't had a check bounce in years!) This morning around 9AM, the same was true, just the two small amounts in the Hold file, the cash deposit still "processing", and no car payment posted. But it was bothering me, so about 3PM I went to the site again. Sure enough, Wachovia had posted the two small amounts and the car payment ALL as being paid on Monday, the 5th. My $20.00 cash deposit is still "processing". And they'd charged me $44 for Overdraft/Unavailable Funds for the two small amounts ($22 each). They posted them AFTER the car payment, so I had two charges instead of one, even though the two small amounts had been on "hold" and the funds not available for my use the day before. I called the branch in alarm, since I don't have $44 dollars for an Overdraft. The young woman I spoke to told me I shouldn't rely on the Wachovia website, that instead I should "keep a register". I didn't have the foggiest notion what she meant by a "register". Well, I keep detailed records in Excel that I suppose is a "register", but a register that I keep isn't a legal document. What matters is when the banks says I deposit money and when they say my money is withdrawn from my account. THOSE records are the bank's responsibility, not mine, so a register doesn't absolve them of their responsibility. Furthermore, if the website isn't reliable and can't be counted on, I suggest they trash it.

    I live in Georgia but get monthly deposits made to my account from California. I have never had a problem until now. My regular transaction was made on 1/5/09 before 2 pm. I checked online and verified this before writing a check. I checked my balance this morning and, to my surprise, I only had $44 in the bank and the check that I wrote had not even cleared. They took $100 out of my savings and charged me a $10 overdraft protection fee. I called to find out how this could be since I waited until the deposit was there to cover this check and now this check was going to bounce.

    I was told that since it was an out of state deposit (cash), it had to clear. I asked, "How was I able to see it if it wasn't cleared?" The not so pleasant Rep proceeded to tell me that what I viewed in my account was only temporary and that not only is the money not there yet but it will not be credited back to the date that the deposit was made. So basically, they ripped me off and purposely hold money in order to charge fees. When I told him that BOA had just lost a customer, his reply was, "Can I help you with anything else?" Some customer service, I'm closing my account!

    Today a man showed up at my house and said he was the middle man between Wachovia and Repo Company. The letter said we owed $1284 and had a due date of 11/08/08? Odd? Also a lady we have never heard from before, a Brenna ** at 888-254-2886 ext **. We owe a car payment for December currently and Jan is not due until Jan 8th. We made a payment on Dec 5th of $500 and Jan 2nd of $500. We are being treated beyond reasonable tactics here. This company is charging me $1800 for insurance so my $365 car payment is $500 and they claim I have over $500 in late fees?

    How can they possibly have me pay $140 over my payment and not cover insurance and late fees each month? This is outrageous! I will be faxing proof of insurance next week to fix that. However, I have had this car since 2005 so why are they breathing down my neck! I want my account looked at as I believe they are mishandling my payments and none of my payments seem to be applied to the principal except for about $100. Out of $500 a month and car payment is $365. Something is wrong here and I need help and don't know where to turn. I truly believe there is something very wrong with this loan and their tactics.

    Consequence: Emotional depression and constant exhaustion from the rude and humiliating phone calls from this company and their threats.

    I fought in court and won a settlement. Never got any money from the individual. Back to the courts and paid $90.00 more out of pocket to get a garnishment. Sent it to Wachovia. They responded back no account found. I have the account statement in hand so I call the number printed on their own letterhead and get some telemarketing company not affiliated with Wachovia at all. Anyway I call the 1-800-wachovia # and get the royal runaround. 3 calls later, I end up with a fax # and am told that I can fax the paperwork to them with the account # on it and they will re-process it. Well I don't hear anything so a month later, I call my local branch account rep (I am a Wachovia account holder as well). I explain everything to him and he calls them and calls me back, "Mr. **, they have no notes on the account at all so they must not have gotten your info." I ask him for a real phone number after I explain to him about their letterhead having the wrong one. He can only give me 1-800-wachovia!!!

    I try that route again. I get some CSR in another dept after 10 min. on hold only to be told that is not her dept but that I should fax the paperwork to them at the same # that I used a month ago. I write my phone # on in 2 uppercase letters. Still no response. I think that I could get the President on the phone easier than Wachovia lien, levies and garnishment dept!!!!!!!!!!! It's been over 3 years since I won this judgement in court and I still am no closer than I was on day #1. Are these people in some underground bunker protected by armed guards or something!!!

    We bought a lot in a nice subdivision with intentions of building as soon as our home sold. Then the market took a nose dive and our house did not sell as planned. We were still making our interest only payment on our lot and not missing a payment. The 12th month came with a new bill. FULL PAYOFF due. $201,246.00. I called in and spoke with many people, telling all of them that I was not having a problem making the $1,400/month interest only payment and could I continue doing that until our home sells so we can then get a construction loan. The response was always NO.

    I asked to refinance, as both my wife and I have over 800 credit scores. I was again told NO. I even offered a Deed in lieu and to lose the monies I had already invested. No to that option too. I asked several people what option I had and was told, and I quote, "Sir, it sounds like you don't have any options. Just let us take the lot!"

    I just recently spoke with Amanda in the law offices handling the foreclosure, and she also said that refinance, extending the loan, or a deed in lieu were not options since the loan was a balloon loan. It sounds to me like Wachovia is looking to run to the government and say "Look at all of these bad loans we have, give us a bailout!" When in reality, they are not giving people any options! I have never in my life missed a payment or been late, and wasn't even having a problem making payments...Now I, too, face foreclosure!! I will lose over $40,000 we invested in this lot and have bad credit, just because Wachovia is a big bully!!!!!! I hate this bank!!!!!!!

    I tried to cash my paycheck from BOA and was told that I would have to pay a $6.00 fee or else, they could not give me money. As I cannot afford to pay a fee, I could not get my money that was owed to me. This amounts to nothing less than extortion. I am forwarding a complaint to my State’s BBB/Court and the Attorney General’s Office in hopes something can be done to stop this bank's extortionist policy. Also, I will tell everyone I come in contact with to not do business with BOA. We loan them billions of dollars and in return, they try to put a fee on anything they can think of. They are a sinking ship, and their time is almost up. To their many workers, I say get out now while you can. Also, to anyone that has had complaints, it’s only going to get worse so close your accounts now.

    I have a business account with Wachovia. I am a small business owner running a Property Management company and we operate on a tight budget. I am in the process of leaving Wachovia after events that constitute what I feel is criminal fee charging practice on the part of Wachovia. Between holding deposits for random periods of time, processing debits BEFORE deposits on a given day (despite the fact that the deposits were made first), causes multiple overdrafts, and processing largest items first, Wachovia has, through their practices generated thousands of dollars in bogus NSF fees off my accounts.

    I've called a bank rep, and a bank officer on these issues on MULTIPLE occasions and have been told that I don't understand Wachovia's FLOAT period... and that they couldn't figure out my account either! They have refunded SOME of the fees, telling me that they're doing me a favor. I would really like to know why a class action lawsuit has not been established to pursue this nationally.

    Not only have they cost me several thousand dollars, but they've cost me in time pursuing the issues with their unsympathetic customer service reps, loss of revenue due to delays caused by my account being pushed into the negative by their fees. They have not only ruined my reputation as a solid businessman, they've caused stress beyond belief!

    A property management business is basically money in and money out. Previous to dealing with Wachovia, we had TWO checks bounce in 5 years! Wachovia's processing of deposits is definitely a moneymaking scheme, which has LOST accounts for me and has made my customers lose confidence in me!

    We have been with Wachovia for quite some time, I have been disabled for the last 8 years and my wife was infected with cancer this last June. She and I have tried to work with Wachovia since and they asked for everything including hardship letters from her doctor and pay stubs, since then. Well they kept harassing us all hours of the night and weekends and I told them that we are working with the loan mitigation dept. and their reply is always, "It doesn't matter it's a separate dept. and we have nothing to do with them."

    I called them on December Tuesday the 23rd and I talked to a lady from Wachovia named Kathreen who said she would keep in touch with us to let us know if a program has been worked out. Well, she never called even after telling her we were making a payment on December 26th. We made that payment which only put us only two payments behind. They took another payment out of our checking account on December 30, and now we are totally broke.

    I went to the branch and the lady there contacted the home office and told them the story but not before being transferred 5 times to different people and finally getting to the right one. They finally confessed that it was their fault, but they would have to do a wire transfer which could take up to four or five days. I told my helper they took it out fast enough they could put it back or cut me a check there in the bank. "Oh no, we can't do that," said Lupe ** of the home office. Then he tells me this, out of the blue, "we can give 400.00 of the 952.00 back and then your new payment plan will be 1372.43 a month starting Jan 1, 2009 or give you the full 952.00 and we will drop the program with you, by the way you can't do anyway, and we will never work out another plan again with you!"

    To me that's a threat! And not working with people as they say they do, look at all the complaints online they have. Now we are totally broke, no money, for at least 5 days and they expect us to take this lying down! Where in the world, are the people that are working with us common people. They can just walk all over us and fly off in their jets laughing.

    I made a deposit that unknowingly had a large check that was not signed. BOA allowed the deposit and credited my account. My balance reflected that deposit accurately. One week later, I received a note dated the same day I made the deposit with the check stating it was rejected for deposit because it wasn't signed. I immediately stopped using my card or checks even though my balance was still reflecting the check went through. I had the check signed the same day I was informed and re-deposited it. BOA put a hold on the check. All during this time, which was over Christmas week, my balance always showed credit for the check and I was able to access my account; however, for about 10 transactions, I was charged $35 per item over limit fee. My wife called, and they reduced a few of them. Then, the day the check hold was supposed to come off, it didn't. They charged us another seven $35 fees. When I called, they were not apologetic at all. The representative, Letitia, said it was my fault for writing checks or signing cards when I knew it wasn't good!

    I used the card because they never told me the deposit didn't go through, and the usage was over the weekend when I had no idea. My balance was still well in the black. When I asked why they didn't call me right away, she said they don't call customers for security reasons. They send notices in the mail and by email if they are on online banking (I am). When I said I have an online account, but didn't receive any alerts, she said I must not have enabled alerts. I told her that I would be closing my account, and she made no effort to apologize or to save my business. It appears BOA is now in the business of increasing profits $35 at a time. These posts indicate a willful and calculated system of extracting $35 fees out of people.

    I spoke with a cs rep about opening a line of credit with BofA. I was never told or I did not hear it that they would be charging me a fee to loan me the money. After they were going to get my interest they then charge me almost $600 in fees to get the loan. They are a horrible bank that should be forced to disclose all of this information or at least give the customer the chance to back out of the loan after receiving the PACKET that is received AFTER they charge you these fees.

    Our mortgage company STOLE our home!!!!!
    We'd NEVER been late on our mortgage payment when around Oct 2007 we received a notice of intent to foreclose from World Savings. When we called, they claimed they had no record of our last three payments. When we presented them with PROOF that these payments HAD been made, they claimed that the payments had been placed in an unapplied holding account due to an alleged $300 short stemming from our Sept. 29 payment.. Problem with this is 1st: the payment in question was made using automated phone payment system which is set up to take nothing short of FULL payment, 2nd: they began 'holding' payments not in Sept, but in AUGUST!!! 3rd: our contract states that short payments would be applied to the outstanding balance, not placed in an 'unapplied holding account' and FORGOTTEN while they foreclose on our house!!!! (World was sued in a class action suit for losing client payments, which we discovered too late to join. World had lost at least six of our past payments over the years, some of which we had proof of, the others we just had to pay again) We attempted to make payment (again) online, as we usually do, but found that we were unable to access our account, we tried calling World Savings but received a message that World Savings was now Wachovia, so we went to what used to be the World Saving branch, with more than enough money to cover at least three months' payments but Wachovia reps claimed that World accounts had not been transferred to Wachovia so they could not accept payment. We made numerous attempts to rectify our account but World could not be reached and Wachovia continued to refuse payment in full, maintaining that World accounts had not been transferred to Wachovia. Months later, we received a reinstatement quote from Wachovia. We were relieved that they seemed to finally have retrieved our account, but when we called to make payment, they again refused, claiming that they did not have the World accounts!!!! I have an email from Wachovia stating this very thing, dated 8 days after the reinstatement quote! This has been going on for a year! Wachovia sent several more reinstatement quotes over the following months but every time we called, they claimed that they did not have the World accounts, so could not accept payment, or they would refuse to tell us anything. We wrote inquiries about once a month but received only vague form letters stating that it would take them up to 30 days to research the matter, and still we never received any answers. They put our house up for auction on Aug, 18, 2008 (it went back to the bank), they came to the door the following day and gave us 3 days to vacate, saying that the sheriff would come to throw us out and they'd sell all of our belongings. We divided our four young children amongst the grandparents and they lost their places in school, all falling behind and traumatized. We are self-employed and run our business from our home. I am management, customer service, graphic designer and marketing director, but since I've been spending up to 12 hours a day fighting Wachovia, our business has suffered as well. Our credit is ruined, our business is sinking like the Titanic, our children have all fallen behind in school and all of us have been severely traumatized. Weve been camping out in our house, with most of our belongings in storage. We were to go to trial Nov 12, 2008 on unlawful detainer, but Wachovia's attorney claimed the judge would likely give us 24 hours to vacate and Wachovia could give us 40 days, we agreed to the latter instead of going before the judge. If we lose our home, we lose our business and will have no means of getting back on our feet, we will have nowhere to go. in short, our lives will be over. We have hard-copy documentation proving all allegations. Every document theyve sent has further served to prove that they are at fault.

    I mailed in my December house payment back in early Novemebr and the 2 checks I sent along with the payment slip that was filled out correctly where not paid and was put towards my principle of my home loan. I began recieving photne calls from the Christams eve day while spending the day with my family. I was being told that my home loan was over due and they where wanting me to may a payment over the phone of 2,382.74. I told them i made the payment and looked it up and both check I sent have clearewd my bank back in November 10th of 2008. I finaly got them to admit they screwed up but now I have to wait to recieve the correct info to make my January house payment that will make me behind for that month. No one will gaurentee me that this will not go on my credit record nor send me a letter too admit their mistake and that this was not my fault in any way. But yet they callled me and herassed me over a mistake that was made on their part. with out correcting it before calling me.

    I have been with Bank of America for about 7 years. This holiday, I went shopping for Christmas but before I went I checked my balance to ensure I had the funds. On DEC 26, They charged me 4 overdraft fees. When I asked them why, they stated that I had some transactions that had not showed up until the 26 that was made weeks ago. I asked them why it took so long and the supervisor decide to belittle me and tell me I should of keep better track of my funds and that it's not her job to add it up for me.

    I've had a free checking account for at least 10 years w/ BOA. Use it mainly to pay BOA credit card bill online so keep under $100 in it until just before I pay the card. Usually deposit a bit over the amount owed, pay the card, check the balance, do it again next month. I've never had a fee assessed until this month. Looked at my online statement and a $20 fee appeared. It was tacked on 12/22/08.

    Finally got a live agent on the internet (they don't have phone service on the weekend). She said my account was switched to Advantage checking on 12/22/08. I didn't switch it, nor did I receive notice about this. The only authority the agent has is to remove the charge and switch the account back like it has always been. She said she doesn't know why or who did this. As others have said on this forum, BOA must be having some hard times. This is shady and illegal. Whatever happened to NOTICE? Watch your accounts people.

    Since I caught this fast and the $20 was returned, only time was lost. However, because I maintain a very low balance on purpose, this recurring and unexpected charge could have triggered overdraft fees of which I would not have been aware. I can certainly see how people who do not bank online and wait for monthly statements could be tricked into overages by BOA. People may say, well, bank online, then. That isn't an option for the poor, most elderly, and many others who are just not computer savvy... millions of people.

    On 12/24/08 my Bank account with Wachovia had a positive balance of $44.96 but... $140.00 later in NSF fees. A fee created a, fee that created 3 more fees. The negative balance if not paid in 60 days will be charged yet another fee of $40.00 plus collection fees. (please see under partial statement)

I will also be sending this to ripoff.com, FTC, CNN as well as Dear Howard. A supposed 5th largest bank that rides on the backs of their customers. I am sure that they laugh all the way to their accounts. I don't think that anyone will care but someone should stop these banks from ripping consumers off!!!!!!!!!!!!!!!!!! What judge in their right mind is going to give a judgment on fees?

    I have been a victim of Bank of America, despite being a loyal and faithful customer of theirs for over 5 years. I have seven, yes seven account with this company. Between checking, savings, CD's, business accounts and lines of credit. I send ALL of my clients to them when assisting them with their banking. Well, not anymore. As an avid user of my BofA Debit Card, I had made several small purchases one week (as I always do), between the days of Tuesday - Sunday, Dec 16-21st. For some reason they did not post until the following Monday the 22nd - despite having been paid days prior. There was one large $366 car payment due on the 22nd which unfortunately would cause an overdraft of $35 to my account. However, BofA decided that the $366 charge would not be the one to overdraw my account but instead every single one of the other tiny little $5, $10 and $15 purchases that I had made the week prior would get hit with the fee - RESULTING IN FIVE $35 CHARGES!!!! The very next day I deposited money into the account, assuming the $35 had been deducted for the $366 charge.

    Well it wasn't enough. Because when they charged me the $175 in fees, it caused my account to overdraft AGAIN - resulting in two more fees. In total, I was charged $245 in overdraft fees. HOW CAN THEY DO THIS TO PEOPLE???? How can a company get away with this? I spoke to a representative on the phone that was condescending, rude, impatient and patronizing. I left in tears, hopeless, as he told me to give up because anyone else I spoke to was going to say the same thing he did - that they wouldn't correct the charges and that it was my fault. He advised that I read my banking paperwork to realize that the mistake was entirely mine. How can I have so many accounts with an institution, consistently refer them business and still not be able to speak to anyone who can offer me some assistance or COMPASSION? I am outraged and wish to cancel all my involvement with this organization. Do not do business with a company that does not respect or help their clients.

    I was charged about $455 in overdraft fees or more in less than one week and received the most deplorable customer service leaving me feeling worse than degraded and literally in tears. The bank is familiar with my family as we have been customers for over a decade. The bank employee I customarily deal with is aware that my husband is diagnosed with terminal brain cancer, and I have asked her to assist me so that we do not incur unnecessary fees. We have always had a good relationship with B of A (especially when our balances were four times the amount they are at present, hmm....is that just a coincidence?) and had and still have adequate savings to cover any overdrafts, etc. But somewhere along the line, B of A changed one of our savings to a checking, and the fees were slammed on us.

    Our account balances have been dropping quickly and steadily since he's been out of work, and with incurring high medical bills (surgery, chemo, radiation, etc) along with my recent job loss, we can least afford any unnecessary expenses or bank charges at a time like this. Because our accounts have been steadily draining, I needed to make some account changes. I visited the branch several times last month to discuss my concerns about my accounts, but the wait time to see a bank rep was always longer than I was able to wait (a minimum of 45 mins or more) and was always encouraged to return to talk when it was less busy for them. Unfortunately, before I was able to ever get the help I needed, I was called out of town a family emergency. The fees incurred while I was called away caring for my seriously ill and elderly mother.

    As soon as I was back, I went to the branch to ask for help but I was turned away and told to call customer service. Customer service on the phone told me they could not help and to go to the branch. I spent hours on the phone with service representatives, one who did a lousy job of holding back his laughter and was sarcastic and giddy with me while I explained the hardship and dilemma I was facing. My experience under the circumstances with this bank employee was traumatizing. It's ludicrous (not to mention cruel) that the bank will not forgive these fees that would never have occurred had they had the time and professional courtesy to service my accounts when I required the attention to avoid these fees.

    I made three trips to see a customer representative, but they were always too busy to help me. Now, especially at a time like this, two days before Christmas, dealing with a terminally ill husband and seriously ill elderly mother, the least of what I can afford is the undue stress. What adds insult to this injury is that I maintain a small business account with B of A as well. A sizable unauthorized withdrawal (presumably bank error) occurred on this account recently, and it took days to correct it, causing me a great deal of stress and inconvenience. I just can't believe the arrogance and insensitivity of bank employees who are allowed (or perhaps encouraged?) to fail to serve their customers properly, causing them additional stress and financial hardship under these circumstances. Had I not been an understanding and patient customer, back before I was called out of town, I would not have incurred these fees. Now that I'm asking for the same from them, this bank is turning its back on me. OUCH!!! Merry Christmas, Bank of America.

    When my grace period was over, I began to attempt to arrange income sensitive payments with Wachovia, but there is no link to get the application on the web page. I had to call, and did in the first week of November. By the first week of December, I finally received the application, which did not ask for a copy of my income paystub from work. When the first bill came for the interest of over $150, my friend had sent the POA concerning his authority to discuss my financial matters, since he can keep his cool and negotiate when they are trying to make him mad and give in to their demands. They not only used the automatic pay I had arranged to have the payment under $72 taken from our joint account, they also took the $150, which we had not authorized. They also delayed the process by wasting several weeks sending the income sensitive payment plan application by mail, not even first class, instead of emailing it to me. I believe they are railroading me to a higher payment plan, and restricting my access to the income sensitive payment plan. Not only this, on the payment plan site giving information to borrowers, there is not enough information on lower monthly payment plans to allow borrowers to access the information quickly and begin the payment process. I am convinced they are restricting borrower options.

    On Dec. 3, I opened a checking acct. depositing $25 into it, on Dec. 4th I deposited 431.51 into my b of a acct. I also wrote a check for my rent which was $649, knowing that it would not be deposited until I got paid on Dec. 5th. So when I got paid on Dec. 5th, I deposited my check for $814 & some change. I tried to use my card later that day and it was declined. I called Bank of America and they said the were closing my account due to risk prevention. So I was ok with that, what I wasn't ok with was that its now 12/23 and I still haven't receive my funds, and they rejected my rent check and I have other bills that are now past due b/c they are holding $1200 and its x'mas time. I called and called and called and they just do not care about people's life or obligations. I am sooo furious and disappointed with this stupid bank! I NEED and want MY money...

    I recently opened an account w/ Bank of America. I don't like to hold cash, so I'm the type of person to use my debit card ALL the time, if not, I would go directly to the bank and make a deposit or withdrawal. In any case, I just found out my account is closed. I was NEVER notified. Now, with Christmas being 2 days away, they closed my account and I am unable to get ANY Of my money whatsoever out of my account. The Bank of America reps will not tell me why the account closed, and will not let me touch ANY of money. This is the worst banking experience EVER. I have no money for food or Christmas because they will not let me touch ANY OF my money.

    Don't know if it's my bad luck or what but I have been having problems with my B of A accounts. Too many problems to list but the most recent was.... Started on 12/9 to 12/10. I had made a transfer to several accounts from one account. It showed the transfer was made so I logged off my online banking. Next day in the morning, I checked my account and that money was back into the original account so I thought that was weird. Didn't question it. I made the transfer again, made sure it transferred. Okay, I logged off again.

    Next day in morning, I checked my account again. I was hit with 2 overdraft fees and now my account was negative. The original amount from the 1st transfer. I was so mad and I didn't call because I knew nothing would have been done, so I sucked it up.... but it has been bothering me. So today, 12/22/08, I decided to called B of A. They said there was no error from their part. So they did not refund the fees. Of course because I had no proof they didn't do nothing. That's why I'm posting this as last attempt to see if anyone out there is having the same problem.

    So today, I'm going to start printing my transaction history at least 3 times a day EVERYDAY (am, afternoon and night), keep record on paper so when this happens again, I will let them have it and possibly file charges. I will have to waste paper and ink but I will catch them once and for all!!!! I have had nothing but problems with them these past months and I'm getting really tired. P.S. I have another similar situation that happened to me about 1 1/2 months ago. I'M SICK OF IT!!!!!!!!!

    I have an auto loan through Wachovia Dealer services. I lost my job due to cut backs. I asked for a deferment on my loan and was told no because I didn't have a job. I went through a supervisor and was told I would have a deferment. 3 weeks later I got a call from Jennifer in collections out of the Buffalo office and was told I was late on my payment because they never gave me the deferment I WAS TOLD 3 weeks earlier I had. She then proceded to get into my personal life by telling me she was sorry to hear I was still with my fiancee.(He had a previous disagreement with her)She called today I asked for the info to send her a money gram she told me she'd rather have them come take my vehicle. After arguing with me about how much I was sending she told me maybe I should be a hooker and then I might actually make some money. Funny thing is I had to argue with them when they took insurance out on my vehicle even though I had full coverage through USAA. It took me a year to get them to take it off then was only refunded $100 out of $600. Not to mention the time they put my payment on someone elses account and told me I was a dead beat and come to find out they found their mistake and refunded the money back to my account. Or the time the accidently took out 6 payments in one afternoon from my checking account causing several overdraft fee's.

    I too had my interest rate on my BofA credit card jacked in Jan of this year... from (roughly) 7% to 23%. I had never been late on any account, credit score in the low 700. They could not give me a reason and could not confirm (on 5 different calls) that if I 'opted out' that my interest rate would in fact stay at the 7%; not trusting them either way, I did not send the opt out form. Jump to Oct. I get my statement and where I had $5K available credit I now have less than $500... Good thing I hadn't charged anything. I had not received any notice of a limit reduction.

    I called and they said, "It's in the mail". I received it 2 weeks later. It was at this time I canceled the card figuring at least they could play any more games with me. I was wrong. Today I received my statement and I have 2 balances... a 5% promotional which didn't change and the purchase which has now dropped to.. .21%. Having closed the card, I thought it was odd that the 21% balance had gone up. I started pulling statements and with NO Purchases... the balance was rising about $300/month. I called and after about 25 mins, I was told that my monthly payment (averaging here) of $500 goes to the lowest interest rate first (I knew that).

    My avg monthly interest amount is $300. Of that... $5.00 is for the 5% balance, the rest is the 21% balance. When they take my payment, The total amount of the $500 goes to the 5% account which is the $5 of interest and the rest to the balance. NONE goes to the interest that is being charged on the 21% account. So when you see your statement of $300 in interest, every other card I have pays the interest with in and the difference goes to the balance. Not with BofA. They are taking the 'outstanding' interest on the 21% balance and applying that to the base amount owed. This has averaged about $300/month for the last several months of statements I pulled. That means they are increasing my balance via interest which they then charge interest on that that new balance.

    THEY ARE CHARGING INTEREST ON INTEREST!!! I will point out that they will not call it 'interest' (though the rep I spoke with finally admitted it was interest). They called it 'Finance Charges' and 'yes' they do charge finance charges on finance charges; perhaps the loophole... semantics. I will not stop accruing finance charges that I will accrue finance charges on until the 5% balance is paid off which is luckily soon... but until then... that will give them another $600 plus interest on that. While I accept fault for not noticing this earlier, it obviously would not have made a difference in their practices. I can't believe this is legal.

    We Owe this Bank $600.00 on a loan. The loan is due on the 7th, of each month. We had no problems out of this bank while the bill was over $1500.00. Since the bill have went under $1500.00 we have been getting phone calls constantly, early in the mornings on the weekends, late at night, on School nights that our 8 year old daughter have to get up the next morning for school. They are calling as late as 9pm disturbing my family. We will be sending half of the balance within the next 2 days, but they are calling us as if we owe them a million dollars. Last month, we sent them more than a double payment, (450.00) when the payment is 275.00. This is ridiculous to be harrassed for $600.00, particularly when we will have them paid within 2 weeks. They have called 10 times within the last 5 days, times ranging from 9 am until 9 pm each day. We never let our payment go past the 30 day limit that would cause it to be sent to a collection agency or the credit bureau.

    My situation is so similar to all the rest that I wish I had read this report before even opening an account. To this minute I have no idea whats going on. Some man named Jared left me a message saying it was important for me to call him about my account. Then when I called he started asking me all these questions about who I was and where I lived and where else I have lived etc. Apparently I passed this quiz and yet he still told me that I needed to come in and close my account because it is some questionably things about my account.

    Bank of America must be hard up. They are driving customers away with their hidden fees. They must know they are going under and are getting as much as they can now. Just hit with $160.77 plus $39.00 in overdraft fees. When I paid the balance by the statement due date to avoid further finance charges, there was another finance charge of $75.05. I was told this was still accruing in between the statement due date. I was told it will take 2 billing cycles to get the final balance of your account paid off. Customer service was very rude and said we have no intention of removing the $75.05 charge that I had been unaware of.

    Wacovia debt telemarketing has been calling for someone (not me) and harrasing me. I just got verbally harrassed by someone when he wouldn't let me speak to a manager. They call a couple times a week and each time I ask nicely to be taken off the list with no avail. Is there anything I can do to stop this?

    After working with B of A for months, due to a medical problem, I was told on Friday by Kieth that I was a dirt bag, and did not pay my bills for a year. And if I wanted to talk business lets talk business!! I told him I would like to speak to a supervisor and I was recording the conversation. He proceeded to tell me that he was a supervisor then he became a specialist. After he literally rapped my background and cursed at me numerous times, I had enough. This call started at 2:45 on Friday, Dec 12th and did not end for at least 1 hour. His co-worker Sue ** , told me two and a half weeks ago that I would have to come up with 2500 dollars. Now they want 6000 dollars and attorney fees.

    I am so glad I recorded this conversation because I will not rest until they pay for what they put me and my family through.. You think the people on wall street are crooks.. Bank of America should be put out of business for the way they treat customers... I am sending a copy of the tape to the banking dept and the attorney general's office and the money that I was going to give B of A I am going to use to bring that little ** Kieth and his superiors to court!!!!

    Bank director & manager refused to respect power of attorney. My 81 yr old mother was allowed to remove me from the bank account when I have been handling all her affairs for many years. I have durable general power of attorney. A bank director made the poor judgement call to cut me off when I am in the midst of handling the process of getting her into assisted living. I have been her caretaker for 8 years. The Dr report says dementia. The bank made the choice to deal with my brother in another state who has not been involved in any of her business or medical affairs for 20yrs. They even told him they would call the police if I come in their bank again. The mgr refused to acknowledge my original notorized POA. I requested it be faxed to their legal dept since she did not understand. She refused.POA was not revoked in the proper legal manner which requires my notification first and my mother is not of sound mind to handle her own affairs.

    I filed a dispute 60 days after the services on my car went south. Bank of America never gave me back my money because they claim to have lost my dispute documentation. I have proven time and time again that I filed within the 60 days and they keep saying prove it again. I finally sent a letter to Edward Hawthorne asking for resolution. Dawn ** called me today and asked me to scan all 45 documents I have and send them to her. I told her that would take me a long time and she said, "Why don't you get the influential people you know to help you?" In my letter I had said that I work for influential people and am not keeping it a secret that Bank of America won't give me back my money. I told her that they have ruined their good reputation in my eyes and I wanted to speak with a person with good customer service skills because I am about to take them to court. She put me on hold and of course no one else called me back.

    Then I called the Office of the Chairman and they were not only not apologetic but told me once this case has been delegated to someone (who clearly doesn't have my best interest in mind) that there will be no one else to speak to. I am taking them to court because they have no regulatory agency I can report them to and usually a judge will side with a small person if they have proof. Sorry for all of you who have to be treated in a criminal manner by this bank. I hope they get what they deserve.

    For the last 4 to 5 months my checking account keeps being overdrawn mainly because of overdraft charges. Back in September after putting over $8,000.00 in the bank from a life insurance policy of my sister who died in August, they put a hold on the account and then started charging NSF charges and sending back checks with that money in the bank. $35.00 a pop. Later they took the hold off, but I was charged quite a bit in NSF. We live on Social Security Disability and with prices going up and having to pay NSF charges, we don't have enough to live on each month. Even if you are just a penny over then they charge you $35.00 and it just keeps rolling on. I have put money in the bank when it says pending, but the next thing I know, it doesn't make any difference. I have a NSF charge.

    I made a deposit on 12/9/08 for 255.00. On 12/10/08 in the am my husband tried to use the card for about 5.00. It was declined. I called the bank and told them the situation and they told me no fee would be charged for the rejected transaction. Yet a fee was charged. This also happened with another deposit a few weeks ago. They rejected some items, did not pay them and then charged me for them!!!!

    My husband lost his job last year and now he is disabled to work, July of this year I was laid off for downsizing and with the help of Wachovia, we are poor, on food stamps and so mad. They hold your deposits and payments in pending for as long as they want, all of a sudden we had over $350 in overdrft fees for a .37 cent shortage, which if they would have put things in when they where supposed to there would have been no overdrafts. This happens every month and we have direct deposit with un-employment payment and Social Security Disability every month but when we get it at least $200 to $300 is snag out so fast by fees and overdrafts.

    I had recently inherited money after my father passed away. My Aunt, who banks with PNC and was the executor of the will had written me a check in the amount of sixteen thousand and two hundred dollars. I went to deposit the money on Monday the eighth of December and the teller told me that there is going to be a hold on the check and it won't be available to me till Saturday morning, however, she said one hundred dollars would be available on Wednesday the tenth. Come Wednesday, the money was not there. So I called the 800 number and asked them to fix it, and they said they would take care of it. In about an hour I called again to check my balance and the whole amount of sixteen thousand two hundred was in there. I was glad that the check had cleared, but just to make sure I went to the ATM and checked my balance and got a printed receipt stating what my balance was. I went that night and purchased a few things. Come to find out today, when I was trying to pay a bill my card was declined. So I called the 800 number again and they said that the funds not only will not be availabe to me till saturday, they said that it won't be available till Monday. I went to the Garrisonville branch and asked to speak to representative to see what had been going on with my account. She came out with a huge frown on her face and seemed extremely annoyed with the fact that I was there trying to check on MY money. She was rude and unhelpful. And when she was trying to explain to me why it is taking that long she said because there is alot of fraud going on. She treated me as if I was someone who was trying to forge a check or scam something out of them.

    Bank of America is notorious for charging exuberant fees for one transaction. My son ordered me a Xmas gift on November 24th & as of December 10th after I stopped doing business with them, my account is still getting fees??? And they charge you every freaking day without your knowledge. If your money is not available & there is an overdraft, I was told they were doing me a favor by allowing me to get my items. Yet they charged me $35 eight (8) times & when I confronted them, customer service was of no help. THEY ARE RUDE BEYOND BELIEF!!!!! I have never, ever, ever spoken to ANYBODY AT BANK OF AMERICA THAT WAS HELPFUL. I will now do my banking at Chase Manhattan. Screw Bank of America & their overdraft fees!!!!!

    I wrote my rent check for $480 and dropped it off, then went to my local Wachovia branch and deposited $160 in cash to cover the full amount. My current balance before this was $322.62, meaning the combined total would be just over what was necessary to cover the check. Several days later, having had no notification either by email or telephone, I check my account status online as I have a small purchase I needed to make. I see an NSF charge for $22.00 and proceed to call the 1800 number listed on their site to find out where this NSF charge originated. For the first time in 6 months, my rent check posted immediately and cash posted the following day, meaning somehow, even with the virtual financing world supposedly behind the real world, the virtual world beat the real world. I asked at the counter before leaving the branch when I made my deposit how much I would have and she told me $482.62 with no mention of a check having been posted at any point, this was on the same day Wachovia has claimed it having posted. I will visit the same local branch and ask if there is any way this can be rectified, but after reading the many other complaints, I will also be looking for another bank. I will also copy the link for this page and post it on every government site I can find. Hopefully the bailouts going towards the financial sector can be made contingent on the removal of practices such as this bank has been allowed to get away with.

    According to the information online on my son's checking account, he was $1.36 overdrawn, but his account was hit with three overdraft charges at $35 each. Then for the next three days, his account was hit with two more overdraft fees (each day). When we contacted BOA customer service, we were told it was because of charges pending... though they weren't showing up as pending at the time. Of course because of the $280 in NSF fees, he became overdrawn again. When we were finally able to speak with Steve, the supervisor, he read everything just like the bank told him to do AND repeatedly said when 'we' do this and when 'we' do that - in an extremely condescending manner.

    When you are already frustrated, the last thing you want to hear is we highly suggest using a register... Oh my gosh, are you kidding me, because they are raping the consumer. Now they are directing us back to a manual paper register - when they encourage the use of online banking by offering perks. Needless to say, I am tired of Bank of America's tactics and unfortunately we are helpless. I'm looking for a good Federal Credit Union, so we will be treated with respect like a good, long-time, customer should be instead of being talked down to, like we don't have a brain cell working and that we are out to screw the almighty Bank of America. After all, there is NO WAY they could possibly know what our intent was...or so Steve said... look at an over 10-year history and get a clue!

    I cannot stand Bank of America - these people get bail out money from the federal government but will charge you overdraft fees up the wazoo for purchases less than $2.00. What makes me even more upset is the fact that you can go to an ATM or use online billing to look up your account balance which will report you have a certain amount in you account but the next day when you check your account, you have a negative balance because some check card purchase you made a week ago which once existed in your pending transactions was not posted that same day. Well if a payment is not posted in my mind that is still pending, but BOA will take the pending purchase off the account and process it whenever they feel like it without including the transaction in the balance. So now they would like to charge me for overdraft fees on the amount of 1.99. I closed my account today and refuse to pay those fees. They can go somewhere with that, they make too much money to ripoff customers for less than 2 dollars. Their online billing sucks and they should be investigated for unfair reporting of balances.

    I had a checking account with Wachovia that became overdrawn. I called the Customer Service number and spoke with an agent to make payments to this account and they assured me that I can open another account that would not be affected by the overdrawn account. THe agent did not make ANY notation in my records so therefore when I put money in the new account they sucked it dry. I have lost over $1000 because of this and there is nothing that the bank will do. It is not even my fault that the account is overdrawn. The bank drafted something 4 times and it is their fault that everything has happened the way it has. I have an Accounting degree and I know how to balance my checkbook and I know how to add and subtract. I am just at a loss here because they are ripping off so many people. Now I have no money to pay my power bill, water bill or buy kids anything for Christmas. I hate this bank!

    I bank with wachovia and this is about the third time they have overdrafted my account for no reason. as of yesturday (12/8/08) my mom did an atm withdrawl for $100 leaving me with $158.29 then i had 7 things go threw on my account which was a $17.11,$12.14,$8.53,$7.22,$6.41,$6.36,and a $4.07 which is a total of $61.84 in purchases which would leave me with $96.45. yesturday i also deposited $700 and the bank teller told me my account balance was $777.00 well first of all where does she get the $77.00 from because im still suppose to be at $96.45 and so i pay my bills yesturday thinking i have my money and i paid $183.99 in bills well my bank statement today says i overdrafted my account and they pulled out $280!! which left me with -183.55 where do they get the $280 from because i even tried adding over draft fees and that still didnt add up.. there is no reaon why my account should have over drafted and now i have $354.30 in my account when i should have $586.01 again this has happened two or three times now and quite frankly im sick of it. im not a mean person but times are tough right now and i cant afford to have them just take money for what they think is a legit reason i would greatly appreciate if something was done about this immediatley.. i was reading other complaints from people and see they dont just do it to me they do it to alot of innocent people trusting wachovia with there money. thanks for your time!

    Something fishy is happening at Bank of America. Today, the bank placed a ten day hold on a routine deposit I made to our small business account. The check in question was drawn on a government account -- an official state check -- and could easily be verified in about ten seconds, not ten days! This is not a new account, it is more than a year old, and I have had other accounts at the bank for nearly 30 years, with no returned checks or deposits ever! Is Bank of America running out of cash? Looking at the other complaints on this site it appears that they might have changed their policies recently to take every nickel they can get their hands on and hold onto it for as long as possible.

    They are legally allowed to hold the deposit, I know, but I have never seen them insist they will do so for the maximum legal time period involved. My advice: given what is happening consumers should ask BofA how long they need your money before they will give it to you BEFORE you make any deposits! I think they should have disclosed the hold before they accepted the deposit and not doing so appears to me to be a form of theft (us giving BofA a loan of our money without our permission). Watch out for BofA -- something very fishy is happening there this week.

    On December 02,2008 I had a child support payment of $145. Deposited into my account giving me a balance of $159.25 the way Wachovia has posted my purchase to purposely overdraft my account My purchase were listed as $1.27, $1.27, $21.37, $10.70, $10.69,and $2.14 that adds up to $47.44 subtracted from $159.25 the next line states $140.00 in overdraft fees they gave me four overdraft charges I have been a customer since Nations bank days. The bank are hurting but I am hurting more I got paid today $300.00 was direct deposited into my account Wachovia let me have $11.66 .I have a copy of my online statement. I should have only gotten one overdraft charge because I was $6.20 short when I purchase my son's winter coat on 12/3/2008

    In 2007, I closed a checking account I had with Bank of America, that was overdraft about $500 ($300 in overdraft fees!) because of unauthorized transactions that kept posting on my account. BOA told me that since my card wasn't stolen, that they could not do anything about the transactions- or the overdraft fees. So, I just closed the account. They did allow me to open a new checking and savings account (I later switched the savings to another checking) and I've had it for awhile now. Besides the overdraft fees that come all too easily, I've had no problems.

    Suddenly, there is a $32.48 debit from my account that is pending, and it just says 'debit/hold' so I contact the bank and they say they have to wait for it to clear. When it clears it says it's from a 'forced closed account' and Bank of America says they are authorized anytime your account has a positive balance to take out the money owed! Not only that, I had about 10 pending transactions from over the weekend, and some PayPal transactions (which don't show up on my account for about 3-5 days) so my account went into negative. I tried to take money from my other checking and put it in and for a day it seemed fine. Then, after the business day was over, I was charged with two overdraft fees.

    Now, I've been on the phone with about five different departments at Bank of America saying I need the transaction code provided back in 2007 in order to fix or even make a payment arrangement for the closed account- and I have to eat the $70 overdraft fee caused by the $32.48 that came without any warning. Every department tells me I need a new department on the phone, and I'm pretty much getting the run-around.

    3 months ago, we started receiving calls from wachovia bank recovery center. they were looking for someone who had a similar name as my husband, in anattempt to recover delinquint credit card balance.we confirmed that they had the wrong person, they threatened to ruin our credit. needless to say they have called 3-4 tmes a day, threatening us. we continue to tell them they have the wrong person, however they continue to call. i was told that i have no rights and they can call as much and as often as they like, even though they are calling the wrong person. the arrogance of them. they told me that i can complain to the attorney general or any one who will listen and they are within there rights. i asked them what could i do to stop this harrassement, they told me to change my phone number.

    On 11/16/08 I took advantage of an offered sent to me via email to open a new checking account online with a $25 minimum deposit and BOA will match the $25 dollar deposit. The application included a co-applicant.

    On 11/18/08 I received and email indicating my application was being processed. A couple hours later, I received an email indicating the application had been denied. I immediately contacted the number on the email to find out what the problem was. After speaking to the customer service rep, she indicated that something was missing off of the application that someone could have easily contacted me and verified. I spent a half hour going over information with her on the phone about me. She resubmitted the application. On a few hours later, I received another email indicating the application had been approved and I should received my account documents and information in the mail within 3 to 10 business days.

    On 11/22/08 (Saturday), I received all of the banking info, a pin number for the account, the check card, signature cards to return etc. I spoke with a representative online chat because I was confused about the PIN info they provided and also because my name was not complete on the card. She told me I would have to contact customer service during banking hours, which meant the upcoming Monday.

    On 11/24/08 (Monday), I contacted customer service to inform them of the name correction, also to inquire about the co-applicant bank card and I was told to contact the risk department because the account was being closed. I called the risk department and asked the rep what the problem was because I had been sent all of the documentation including the bank cards and his response was BOA has the right to close an account without any given reason or notice just the same way a customer can close an account and not inform them as to why. I clearly indicated to him if there is a problem, how can I fix the problem if I do not know what it is. Was it Chex Systems or something else.

    So unsatisfied with his rude response I drove to a local branch. A personal banker then called the same number I was given and they told him the same thing. Again unsatisfied, I went home and tried several times to get an answer, by now it was after normal banking hours. So I then went back and contacted the application department. I spent about 40 minutes on the phone with a representative who was actually really nice and took the time to investigate the problem. He informed me that myself, but mainly the co-applicant had to go in and show proof of identity and residence because they may been a victim of identity theft. I was informed this information was on some kind of system that only BOA uses called the Merlin System which basically is a legalized hacking system. Of course, once this information was retrieved it was now after banking hours and I would have to wait until the next day.

    The following day, myself and the co applicant went back to the branch and gave them the information that was provided to us. The personal banker once again contacted the risk department and gave them the whole story and the risk department told him that it was too late to submit any information because we missed the deadline which was the day before.

    If you notice, I did not indicate that I had to complete any of this by a deadline because I did know there was a deadline, which was the same day the account was closed. And I would not have known about the closure if I had not called to inquire about the check card and the completion of my name. I was then informed that since I missed the deadline I could NEVER open an account with BOA again. However, the rep that provided me with the information and told me what I needed to do, told me that I could reapply and open and account with just myself and once my co applicant can correct their information, just add them to the account.

    It isn't that I need the account because I do have another one, it is the principal. BOA did not want to help, I have spoken to several rude people and just the same today. After contacting the application and risk department today to inquire about the deadline I knew nothing about again I spoke to a rude women in risk named Pam who told me that when I went into the branch they obviously weren't willing to stop the closure because the branch manager can override a closure and since they didn't do that when I went in on the 24th to get answers, I can never open an account with BOA once I have had one closed regardless if the reason for closure had nothing to do me.

    These rudeness of customer service is beyond anything I have ever dealt with. Pam clearly informed me that they can close an account at any given time and they DO NOT notify the customer of closure. I presented a scenario that if someone balanced their checkbook and wrote checks to pay bills or whatever knowing they had available funds but BOA closed the account without notification and therefore all the checks would bounce. She said it is not their problem, that you should check your account beforehand, that is why they have the automated system and customer service. But in the event that did happen they would not honor the checks and charge fees on top of it.

    I had an account with BofA that was used for my condo's HOA where several signers were on the account. One of the owners of the HOA released his interests in the building and therefore we had to have his name removed from the bank account. This person also had a business bank account at BofA that somehow was linked to the account used by the HOA. We were told by several people that in order to have a name removed from the account, we either 1)had to close the account or 2)we could have all the other signers write and sign a letter asking BofA to remove this person's name from the account. We went with option 2 and hand delivered it to someone at the local branch. I had not yet put my name on the account and when I did that with one of the other owners, we asked the bank rep if the name of the previous owner had been removed and she replied that he had so we did not think any further action would be taken.

    Shortly after adding my name to the account money started getting transferred to an unknown account. It turns out that BofA had never removed the previous owners name from the account even though we attempted to get the name removed and received verbal confirmation that it was, so they started transferring money to his account to cover overdraft charges he was incurring. BofA now refuses to reverse the transfers and the HOA is now out $600.00 which is a lot of money to a small HOA. I have spoken to at least 3 different reps, and a supervisor and they were all unwilling to help.

    I was charged 3 overdraft fees for $ 35.00 each for transactions processed on Nov 28th. According to when I used my debit card, there were only 2 transactions that took place on the 28th, of which only one would have overdrawn my account. When I called the bank to find out why I was charged 3 fees, I was told that the bank charges fees based on how much is in your account the day you use your card AND the day that the bank processes the transaction. So, according to the bank, it didn't matter that I had enough money in my account to cover all transactions that I used my card for, by close of business on the 27th. The fact is that by the time the transactions were posted I needed to account for all of those, as well as what took place on the 28th.

    What upsets me about this is in the past, I have been charged fees and if you look at the date that the bank finally processed/posted the transaction, I had enough funds to cover, however, when I questioned the bank I was told that I'm sorry the bank doesn't look at when the transaction gets posted but instead looks at the date you actually used the card. In those instances I have been charged a fee. Now today, I had enough enough money in my account to cover based on when I actually used my card. But now the bank is changing their story to say that that doesn't matter. They look at when the transaction gets posted AS WELL AS the actual day the card was used. I got very frustrated with the rep who started to make an analogy using apples. Saying that if you promise your neighbor 5 apples.... I had to cut her off and ask her not to use that type analogy with me and that I was an accountant and understood numbers. The rep then went on to say "ok if you are an accountant then simple math is...."

    She ended up being rude and unprofessional. I asked her full name. She told me Angela ** from the Southeast region. I asked if she had some employee ID# and she said no, that was her identification. I then asked to speak to a manager and she told me that she would put me through to her manager's voice mail. I said I don't want to go to anyone's voice mail and that I would speak to any manager that was available. I was told there was no available manager that I could speak with. I did end up leaving a message for someone who I couldn't make out their name due to a heavy accent.So, I was left out in the cold with as far as I'm concerned, unsatisfactory customer service and I can't truly identify who I spoke with. So again, THE BANKS WIN!!!!

    I submitted a letter of hardship in early november to request a deferment on my november 15th mortgage payment. I called on November 28th 2008 to check status. I was told that the deferment was approved for november 15th payment as well as December 15th payment and that i would get a letter in the mail to confirm this as well as to sign and fax back to wachovia. Since I did not get any letter 3 days later, I called wachovia and asked what was going on. at that time, they told me that the deferment had been declined and there was nothing they could do about the huge mistake they made by orginally telling me that the deferment was approved. I almost had a heart attack! since i was told it was approved, I had taken the extra money and paid off some past due bills and save some of it for my property taxes. Now, because of their mistake I have to make a miracle to pay the payment which is now overdue. I can not believe that a bank in the united states of american can be so shaddy and make such a huge mistake like that. And of course, the supervisor was not at all helpful. He said there was nothing they could do but to waive the late fee. This is an outrage, how can a bank get away with this?

    Bank of America's change of heart - which is not to say that they have one - is hurting my credit! On Friday, Nov. 28, I opened a checking account with Bank of America. (I already have a checking account at Washington Mutual - exceptional customer service, by the way! - but was getting ready to travel in an area of the country where WaMu branches and ATMs aren't nearby. ) My total balance the day I opened the account was roughly $375. Over the weekend, I made a few cash withdrawals, used my debit card several times and also arranged an online payment. On Monday, I tried to check my balance online, but my user ID, which had worked just fine the previous day, wouldn't work. I called the customer service line and spoke to a representative who said she couldn't help me and gave me another number to call. When I called that number, I was told that Bank of America had determined that I was "a risk" and was therefore closing the account.

    Since I'm not on Chex Systems and had passed their credit check, they opened the account, but later determined I was too risky. (I've opened accounts at similar national banking institutions in the past few months without any problems, but BoA apparently has different criteria.) I explained to the associate that I had outstanding transactions and also needed money from the account for little luxuries like gas and groceries. He just kept repeating that the bank had decided to "terminate the relationship" and would send me my funds via check in 10 to 15 business days/two to three weeks.

    In the interim, I wouldn't be able to access the funds because the bank had decided to freeze the account. Sure enough, when I tried to withdraw some gas money from an ATM, a message on the screen informed me that my card was invalid. On Tuesday, Dec. 2, I spoke with a manager who had introduced herself to me when I opened the account and asked me to let her know if she could ever be of any assistance. Well, I definitely needed some assistance. After reviewing my account, she said that the bank would pay the debit card transactions but would reject the online payment of $25. When I asked why they were rejecting the payment even though the funds were there, she said that the funds actually weren't there because the bank had frozen the account.

    Huh?! I said again that the funds were available - and then some - and she said again that the bank couldn't approve a transaction of that amount. (Is the economy so bad that $25 is considered a risky transaction - even though the funds are there?) I explained that if the transaction didn't clear, it would be reported on my credit report as a late payment, negatively affect my FICO score and remain on my credit report for seven years - through no fault of my own but because the bank arbitrarily decided to close my account, without even notifying me. She apologized and said there was absolutely nothing she could do to override the system. When I pointed out that the bank hadn't even been courteous enough to inform me of the reversal of their earlier decision, she said I'd be receiving a letter in the next couple of days.

    I've heard numerous complaints about Bank of America through the years, and now I understand why they are always mentioned at the top of poor customer service surveys. Had I known they would treat me this way, I obviously would never have applied in the first place. I'd much rather pay some extra ATM fees than deal with a bank that's sold its soul at the expense of its (would-be) customers!

    On Nov 6, 2008, I signed up online for the Keep the Change Program offered by Bank of America. On Nov. 7th at 4pm, my checking account was closed. I only knew about this because at 5pm I was trying to use my debit card at the local store. It was declined so I promptly called the bank to find out why. Once I called, I was told there was a hold put on my account because of some fraudulent activity. I asked for the hold to be taken off, and I was told I needed to call the security office, which had put the hold on the account (at 4pm on Friday) which happened to also be closed for the evening, and was told they did not reopen until Monday.

    After many of complaints I finally got a hold of someone on Saturday who stated my account was being closed because there was no telephone number listed on my account. I was never asked for one. I was then told the remaining funds would be sent to me via certified check and there was nothing else I could do. I could not reopen the account, or pick up my money at the bank, only wait for this certified check. So now I sit with no funds whatsoever and get fees for every check that is not returned to me.

    After about 10 days I had not received any check, and my direct deposit had cleared into the account on Nov 15. I again called the bank to find out why they accepted money into a closed account. I was then told they were waiting to close the account fully and they will take deposits, but no other transactions. I finally was able to get off of my military base and visit an office in person. I had come to find out I was even charged overdraft fees by Bank of America. I have finally gotten my account reopened and have withdrawn almost all of my money at this point, however have still suffered huge financial problems because of the closure and them holding my funds and refusing to let me withdraw any of them from my account.

    My boyfriend signs his weekly check to me and we had been depositing them in the ATM during our Friday lunch hour to save time as Bank of America claims their new check scan will allow funds to be accessible immediately. Until of course, they freeze the money 3 days after deposit and don’t clear such for 10 days!!!

    After depositing two checks in the amount of 1004 one Friday before we were to spend 3 days at a friend’s wedding a hold was placed. Both online and ATM accounts listed the funds to be cleared on Saturday so we went on our ways using the funds that weekend. On Monday when we returned a hold was placed on the checks due to the name on the account and signed over check in a different name. Fair enough, we went down to the bank to clear up the situation. Apparently, someone in Arizona (we live in Massachusetts) placed a hold and did not return any of the branch manager calls as to what form to sent to clear the issue. We were left for 2 weeks with no money due to a bank error! Then when I called to refute the numerous overdraft fees that were inquired over the weekend the bank had the nerve to say it wasn't a bank error but mine as I used fund on an unclear check that they deemed uncleared after they listed it as clear!!

    Then 2 weeks later a check my cousin wrote to me was returned due to insufficient funds. However, again it was listed as clear and then 4 days later as on hold. Bank of America didn’t withdrew that amount 2 times!!!! A bad check from someone else was taken out 2 times from me (totalled in 600 dollars!!) When I called them back to redeem this situation they said I would have to wait 2-4 days for a letter in the mail to confirm the refund of this money and any over draft fees cause by it. Yet again, I am left for 2-4 day with no money to eat or pay my pending bills!

    It should be illegal for a bank to take money that does not belong to them and have the ability to hold it for however long they deem fit.

    For a $2.00 mistake, overdraft. Because of this overdraft, I was charged $210.00 in overdraft fees at $35.00 x 6. I have online banking and monitor my three accounts, the overdraft in question was taken care of the same day it happened. But they continued to take fees after I kept putting money in by transfer. I want 5 of the six refunded to me. This was Christmas money I needed.

    Bank Of America is robbing my daughter-in-law with their overdraft fees! We were told that a check deposited in the ATM would allow a transaction to go through. It didn't and she now has 7 or so overdraft fees @ $35 a pop for small purchases ($4, etc) because of the initial overdraft. The service center was rude. They refused to help her out saying it was her fault because the check was deposited at 5:05 and missed the deadline. I specifically asked the person on the phone if the check would be counted that night. He did not tell me to check the time when items would be collected. I would have had time to go to the next little town where the branch is opened until 6 if I was given the correct info.

    Bank of America refuses to take any responsibility for this situation. They are punishing my daughter-in-law for being working poor! My daughter-in-law will be charged close to $300 and will just have to let the account go to collections. Bank of America is robbing my granddaughter of food by stealing her mother's money! This bank needs to be stopped. I've been a Bank Of America customer for 10 years and will be closing my account as soon as I can. Bank of America needs to find out that it can't make it without the little guys!

    I think that Wachovia has unfair banking practices. I made an error in my checking account that would have resulted in only one overdraft fee however even though other purchases were before they take the highest and bounce the rest creating unfair charges. I feel powerless because they refuse to do anything about it. The money was there for all but one but they create by taking the highest to the lowest.

    On Tuesday, November 25, I noticed my checking account was negative by $0.60. I talked to a representative on bank of america's website and was advised to go to the bank and make a cash deposit before 3 pm that day to make sure no overdraft fees would occur. I drove 45 minutes to the closest location to make an $18 deposit. It was 8:30 am exactly. I know because this made me late to work and the drive-up had just opened. The woman at the drive-up said I wouldn't receive an overdraft fee. Later that day I checked my balance, and I was out of the hole. Wednesday morning my direct deposit from work went in and I was quite a bit of money. I checked my bank account again at 5 pm that same day. I HAD AN OVERDRAFT FEE! I was fuming.

    I got on their website and talked to one of the representatives who gave me a courtesy refund. WHICH DIDN'T POST UNTIL SATURDAY NOVEMBER 29! I checked my account Saturday morning I was negative! How could this be?? I checked, they charged me two extra overdraft fees! When they charged my the initial overdraft fee, it sent me into the negative. I had two pending transactions of between $2 and $4 dollars which had not posted. Since the $35 was not returned until Wednesday AFTER those two transactions had cleared I went into the negative. Again fuming, I contacted Bank of America, someone (I'm sure not from AMERICA) told me there was nothing they could do, asked to speak to a supervisor who was extremely rude. She told me there was nothing she could do and it was my fault not the bank. Well not in my opinion. I contacted a local branch and spoke with a manager. She said she had no idea why I was charged the two overdrafts and that her computer would only allow one refund. She gave me the refund, leaving me $28 in the hole. I managed to get to the bank today and deposit the money. Bank of America is a rip off.

    Overdraft fees of their ways of doing business which is illegal. I personally am out, for the past year, over $1000. Of bogus OD fees. Just like all others that have posted here, please let all of us know what and where we need to contact. They must be stopped. Where is the/Our legal system???? Where do we go to get our $$$ back that this banking system has "stolen" from us. If this continues, and the legal system does nothing to stop it, do we all have to show up on the Capital's steps. Please bring back the morals and values that the forefathers of our country, wrote and signed! The constitution of the United States of America.

    Wachovia has overdrafted my account several times and it has happened again this past week. A $105 overdraft fee was taken from my account when I still had money enough to cover the charges. The past times this has happened I went to my local branch and the people there ran me in circles with talk about fees and sequence of transactions, but I keep a good tab on how much I have (even though it is a mental tab so I can prove it). Anyway, I looked at my account online and everthing went in an order that didn't overdraft anyway. I am changing banks but I want my money back first.

    These investment specialist have succeeded in losing over half of my husband's retirement account. Then they sent us a form saying we needed to move to self-directed investing when we had so little left that it was not feasible for them to continue to manage our account. We now have not enough left to retire on or really do anything else with. Loss of over 150,000.

    I noticed 2 $35 fees, total $70 drawn from my account. Upon calling them, they stated I removed my overdraft protection and that was the charge. In fact, they argued with me that I had to call and remove it. It was illegal for them to do it without my permission. I did not remove it, makes no sense whatsoever, they are screwing people and taking their saving to cover bad debts from other customers. Just look at their credit card INTEREST! I closed my savings, will pay off the card and they can kiss my ass. Now I did tell them they could do that!

    Run, don't walk as far and as fast as you can if ever approached for a loan by Wachovia! Working in the construction industry, my husband and I were not able to make our October and November payments for our Suburban. First time ever (as admitted to by Wachovia personnel). Doesn't matter to them for the last 2 weeks, I have been harrassed, belittled and humiliated by this company. Last Monday, I call and speak to Maria to make payment arrangements. I told her that I can make a 1/2 month payment on the 5th, another one the following Friday (the 12th), a full payment by the 19th and since I would have December's payement come up during that time, another full payment by the 26th. This would make my account 100% current by the within 30 days of our call. Maria informs me this isn't good enough I have to pay her immediately. Being Thanksgiving week, I explain that's just not possible. Maria informs me that's not her problem and she won't guarantee the truck won't be picked up. We hang up. I call back to make sure I had her name correct and speak with Xavier, who informs me that it's Maria's call as to whether or not the truck gets picked up. On Wednesday, I receive a call from James. I explain to him what happened Monday with Maria and he tells me she noted in the computer she spoke with me and he's trying to get a payment arrangement. After a lengthy conversation with James, we agree to the terms I had attempted to get with Maria. Then he tells me the checks have to be post dated. I explain the payments are coming from a corporate account (for our dieing construction company) and we aren't allowed to post date checks. James says I'll have to speak with his supervisor. A Danny M. gets on the phone and I explain all over again. He tells me to get a loan from someone else for the payment and get terms from them. He tells me if I don't post date the checks, he won't help me either. I tell him again I can't post date checks. He says "Guess I can't help you then - your choice" and hangs up on me! I start calling around and am able to get the money together to make a 1/2 payment on the 1st, a 1/2 payment on the 5th another full payment by the 12th (which catches me up 100%) and money for the December 13th payment by the 19th. I call James back and tell him what I can do. He says "Okay. Call us Monday with that payment, ok? I'll tell my supervisor." Alls good, right? Nope! This morning, the Friday after Thanksgiving, some lady calls my cellular (I had given the number to James on Wednesday in good faith to prove I was going to make good on payments)and tells me she wants a payment TODAY! When I tell her I'd already spoken with James Wednesday and I was making a 1/2 payment Monday, she says (and I quote) "Let's be real Kristi. You and I both know you haven't spoken to anyone here about making a payment." I lost it. I told her all the people I'd spoken to and the arrangements I was making. I explained that I'd even spoken with a supervisor named Danny who'd hung up on me. She says "I'm sitting right next to Danny and he says he never talked to you." Well, either the guy I spoke with on Wednesday was a liar or this lady was. Either way, I knew I wasn't lying. She gets nasty and when I ask her why she's being a b*tch to me, she says I'm not making my payments and I'm asking why she's being a b*tch? I burst into tears not knowing how much more I can take of this company. She tells me clean out my truck, she's sending someone over tomorrow to pick it up. When I get home, I'm sobbing! My husband takes my cell and calls the place back. He ends up talking with Xavier (from earlier in the week) who says James isn't there and they don't show a payment plan in the computer. My husband tells him we're tired of being harrassed by Wachovia, come get the truck. He tells him it'll be parked out front with the keys in it. Xavier says that's not what they want and he wants to work with us. We now have payment arrangements just like we had requested. Xavier apologizes, says he remembers speaking with me earlier in the week and that if we need to defer a payment, just let him know! For a bank that's been on the news having financial problems, you'd think that they'd be a little nicer. I will spend the rest of my life making sure people know the reputation of this company! Never, ever, ever do business with Wachovia!!! They employ mean, hateful people. I hope they can all sleep at night.

    Fees being assessed to my account that are not accurate. I started with a balance of $259.70 on 10/24/08. I made a cash deposit in the amount of $300 at 10 a.m. There were 4 debits that posted on 10/24/08 totaling $179.00. These posted transactions were activity from 4-5 days prior to the posting date of 10/24. On 10/25/08 I withdrew $120.00 from the banking center drive up teller. My statement is reflecting this order of transactions.....

    $259.70 balance; $120.00 withdrawal 10/25/08.....($139.70); $90.00 debit from 10/24/08......($49.70); $30.15 debit from 10/22/08.......($19.55); $25.00 debit from 10/21/08......(-$20.45) FEE ASSESSED $10.00 debit from 10/22/08......(-$30.45) FEE ASSESSED $8.38 debit from 10/22/08......(-$38.82) FEE ASSESSED;Cash Deposit $300 from 10/24/08....

    This is $140.00 in fees that were assessed to my account for transactions that were not accurately accounted. If I put CASH in my account and it is in before the same day posting cutoff time, and a day later take out $120.00 they cannot be flipped around just so the bank can charge me $140.00 in fees. They have resorted to stealing from their customers. It eventually now has spiraled into 10 fees totaling $350.00.

    On October 4th I paid $35,000 towards my line of credit which had a balance of $53,000. The banks says that on November 17th my payment amount was to be $884, which was the minimum based on the prior balance. I had sent them $500 on November 3rd in expectation that the minimum would have been reduced. However, I was contacted on November 25 and told that my minimum was not reduced and that I was late on the difference. Additionally, that my credit line was now frozen and that it would remain that way until the balance was paid. Furthermore, that the minimum would not reflect the new balance.

    I find it hard to believe that I could in good faith pay such a large amount towards my balance only to have them freeze the account and then state that the minimum would not change. This is not the agreement I had signed which states the minimum is based on the balance. My main frustration came when the gentleman said "we are the bank, we can do what we want!!!!!"

    This is the 3rd issues I have with BoA. July 4th weekend they claimed their teller entered the wrong number and they tried to withdraw $3000.00 from my account which flagged my account and froze it for the weekend so I cancelled all plans because I didn't have access to cash. I tried to open another account with my wife because I just got married and the credit union I wanted to open the account with said they couldn't do it because I was put in the Chex Systems and it was from BoA and I was still banking with BoA.

    So, I have to wait for BoA to investigate to see what happened before I can't even open an account anywhere else. Also, from what I was told the name from BoA that claims I owe them money isn't even me but it has my account number on it. 3rd incident happened on the 17th of November. A payment went through for an American Express card of which I don't have an American Express. I called and they said they can't do anything about it but they have to investigate this also before I can get my money back.

    Initially had an agreement that when my employees cashed their check, they would not have a $6.00 check cashing charge. Bank of America has recently changed that agreement and now have implemented the fee. In my opinion, Staff Relief money is in this bank and we are asking them to transfer the money to the party that it was issued so now fees should be charged. I have been with this Bank of America since 1991. This is causing a hardship on some of the employees as they are Certified Nursing assistant and live from week to week. Bank of America broke their agreement with Staff Relief Inc. I would like to know if anyone has a class action lawsuit against Bank of America. I realize that the lawsuit in California regarding check cashing fees had been won but the attorney in CA used an 1911 California law which I don't think Georgia has.

    A sum of $20,000 was mysteriously transferred from my overdraft protection account into my checking account on 11/19/08. I had made two transfers in the reverse direction (from checking to overdraft protection) on 11/18/08 each for $200.
    Wachovia's Fraud Protection Dept. explained to me that the mysterious transfer for $20,000 the following day was also put through on 11/18/08 at the time that I made the two $200 transfers. Given this information, I can only conclude that it was some bizarre combination of human and system error even though I have no recollection of having any trouble putting through the two transfers. The Fraud Dept. also concurred that this appears to have been a transfer made in error and made a note of that in my account. I immediately paid back the $20,000 on 11/24/08 (the day I became aware of it). In the light of the above circumstances, I requested Wachovia Customer Service to reverse the $656.96 in finance charges that was levied in connection with the $20,000 transfer. They flat out refused to do so, saying it was not a bank error and could therefore only reverse $56.96 of the charges but not the balance of $600. Not only is the finance charge of $600 (3% of the cash advance amount) outrageous, but their refusal to make a consideration in this case given the possibility that it was made in error makes me mad as hell!

    Rude customer service and steal the maximum. I had a E-ZPass commute and I have set it up to deduct from my checking account. It got deducted all of a sudden and wasn't being displayed as pending transaction the whole day. Next day I saw it got deducted and whatever small transactions... they charged overdraft fees ($35 three times). I had deposited the money on the next day. Problem here is Bank of America takes the overdraft fees first and the transaction I make the next day. I get overdrafted again ($35 twice). I know this was my miscalculation. I end up losing about $180 in total.

    Couple of issues - BOFA says it is not obligated to show all transactions as pending on online bank statements...so it's hard for me to track what's pending that day and they were rude to say it's your responsibility to track and not ours. Also a transaction I made a week back, it falls on the day when the account is less and there is no way to know if BofA is doing it on purpose to make overdraft fees. Overall they are mean enough to take any amount of hard-earned dollars from the customer in the name of overdraft and nothing can be done. I seriously hope some day they would be in the receiving end and get bankrupt.

    To all who have complained about Wachovia, (walk all over ya). It has taken me over a year now to get over this and still i haven't recovered completely either finacially or emotionally. About September of 07' I was driving to a job site in my truck, an 01' Dodge Ram 1500. My wife, who was at home with my then 2 month old son called me up crying saying they're here and they want the truck. So I talked with the tow truck driver, and he said there was nothing that he could do as we were some 5 months behind on our payments and they had been looking for us since June. However, we had moved in may of 07', and had sent two letters of address change to the post office and a change of address form to all of our billholders. We also could prove that we were in fact only 2 months behind on our truck payment. At the time i had a $3000 set of rims and tires on my truck that had been given to me for christmas by my mother. My biggest mistake was to let the tow truck driver take my truck as is, with the wheels and tires on it. All in all we were only behind about $500, however, Wachovia charged us a $300 towing fee, a $250 restoration fee, and wanted us to pay for two months in advance to get our truck back, bringing the total to get my truck back then to over $1600. All of which I would of had to pay within 10 days. I argued with Wachovia about getting my rims and tires back and I said I will gladly put back on the stock rims and tires myself. However, Wachovia said what is on the truck is part of the truck. so finally I got all the way to talk to the secretary to the office of the president, or so I was told, and they said that there was nothing that they could do. I told them that this was nothing more than corporate America taking advantage of a blue collar worker. since this time I have sent many chain type emails to many of my friends and family across the country and this horrible news has now reached almost 10,000+ people. please help me to pass along the truly disasterous and undignified way that this scam of a business is treating people!!!

    Customer service repeatedly does not respond to request by emails. They withdrew money from my bank account earlier than I specified, and this resulted in several overdraft fees from my local bank. I told them the damaged that they caused in an email to them through their website, but they haven't responded to me with an explanation still even a week later.

    Bank of America debited my balance of $1,100.00 from my checking account without prior notification. When I called BoA customer service, they told me that my Wife Business Credit card was in default and they took the money out of my Joint checking account. I do not think it is legal to withdraw money from a joint account to by a business card to a sole person. Even the IRS has a form Injured Spouse? Which protects the innocent party and does not allow a collector to collect a debt from an individual to a joint account. How can it be possible for bank of America to debit my JOINT checking account to pay of a debt on a business credit card to an individual?

    We bank with Wachovia (although not for much longer). We had a $75 balance when 4 transactions went through. The transactions were for the amount of $68.15, $42.85, $14.27, $2.06.
    Instead of deducting in the amount processed, they deduct in the highest amount first on down. We had enough money to cover the lowest 3 amounts, the 3rd amount went through first though, making the other 3 bounce. We were charged $105 in overdraft fees. We called Wachovia, first the local branch. The lady said since it was not a banking error, there was nothing she could do. She told us to call the 1800Wachovia number. We talked to one lady, she said there was nothing she could do. She forwarded me to her 'supervisor' named Chad. He said that there was nothing he could do, the system is set up that way. I tried to speak to his supervisor and he said he didn't have one. He then forwarded me to an address to complain. I told him their system was flawed, he didn't agree. We were trying to find someone to talk to that understood what we were saying and to get help with. Right now we are only bringing home $170 a week, and after these transactions this is one entire paycheck for us. I don't understand how a company can get away with doing this. They told us we were over drafted, but we had enough money in there for the three transactions we were charged for! Yes, one would have bounced, we would have been fine with paying the 1 over draft fee, but not all 3 of those that would have cleared. (Before anyone says 'oh, don't spend it unless you have it.' The $68 transaction came early for the first time since we had the account, we had just deposited money to cover the $68 the day before it was suppose to come out, yet it came out early anyway.) Wachovia is ripping off their customers with this scheme. We are out one entire paycheck because of this, we are not rich, we cannot afford $105 out of a paycheck because that is 85% of the entire check for us. Why are banks getting away with this? We had money to cover all but one of the transactions, yet they charge us anyway.

    I recently applied for a loan from a Bank of America from a mail solicitation. I have an excellent credit score and applied for the loan, calling the toll free number on the application. Someone from BOA recorded the information including my home, cell, and work numbers as well as my Social Security number, address, etc. I applied for the loan on November 2, 2008 and heard nothing from BOA in the ensuing weeks. I received a credit alert from Experian on November 17th that a new account had been opened in my name, and when I checked my credit report, I found Bank of America had opened a loan in my name. To make matters worse, the credit line was for $500 and not the $20,000 I had applied for.

    I contacted Bank of America to complain and was transferred to a credit analyst who informed me I didn't qualify for the amount I had requested, so they decided to open a loan account for me in the amount of $500. I informed them that I did not want the $500 loan, nor did I ever give them permission to open the account without contacting me first. They replied they had tried to contact me and I never responded. Bank of America is lying: I never received a call from their credit department about the loan application. I feel this is a predatory lending practice by Bank of America to entice consumers into opening new loans under false pretences.

    I had an open line of Credit linked to my Checking account. I always kept it at a zero open balance by the end of the month. BOA decided to close my account. WHICH IS FINE. During this period before me finding out they closed it, Several transactions bounced. Which if the line were open would not have. This resulted in $245 in bank fees from 10/27 to 10/31. When I called them back, I wanted nothing more than from them but to refund me the $245 in fees I had been charged for my account being overdrawn instead of the credit line processing that. I was TOLD, "YOU WERE SENT A LETTER, NOT OUR FAULT YOU DIDN'T GET IT." After getting that same response from several supervisors, I gave up.

Not onlt did they put me in a bad loan when I had good credit they put me in a bi-weekly payment plan which means you make 2 extra payments a year. I didn't ask for it.     Bank of America can get bailout money, but I guess it's not enough to use tax payers dollars to float your business and claim in front of Congress that your doing the right thing with the borrowed money. So you blindside credit card holders with outrageous rate increases for any reason they see fit. We, the consumers, who do everything we can to stay in good standing. Have had the rug pulled out from under us. We were forced to used Credit cards to buy gas and food and maybe we cant make more than the min. payment, but we pay on time and what we get in return is being ripped off and beaten further into the ground. These Credit Card companies should not be allowed to take advantage of people like this. We need help.

    I have personal and business accounts with Wachovia. I am a small business owner running a young company and i operate on a tight budget. I am in the process of leaving Wachovia after a LONG string of events that constitute what i feel is criminal fee charging practices on the part of Wachovia. Between holding deposits for random periods of time, processing debits BEFORE deposits on a given day (despite the fact that the deposits were made first), holding debits in check card hold pergatory (only to release them when conditions are conducive to causing multiple overdrafts), and processing largest items first, Wachovia has, through there practices generated thousands of dollars in bogus nsf fees off of my accounts. I've persued these issues on MULTIPLE occasions and in addition to being told sorry, its our policy they've usually refunded SOME of the fees, (after i've threatened legal action) telling me that they're doing me a favor. I would really like to know why a class has not been established to persue this on a national level. I KNOW it's not isolated. I've read AND heard hundreds of complaints and i know that if the right attorney got involved it would be a practice that would not only be overturned, but also yeild a payback to hundreds of thousands of people who have been robbed of thier hard earned money.

    I had been banking with Wachovia for just over three years before, a month ago, I wised up and moved to Commerce Bank (which is now TD Bank).
    Like many of you, I too have suffered the consequences of trusting Wachovia with my money. But the one thing that really ticks me off more than anything is the way they decide to process checks and debits. On Multiple occasions a circumstance would arrive where I had made one purchase too many on my debit card, resulting in sometimes as little as a 20 cent overdraft. Then of course, the minute that happened the check they have been showing as on hold for a month goes through which caused me to have up to $600 in overdraft funds. I'm really bad about keeping my checkbook balanced, etc. so I figured it might be a smart idea to look into overdraft protection. Not only were they going to charge me to open an overdraft protection account... they were going to charge me $10 every time to use it. So to make this clear, they were going to charge me $10 dollars every time I needed to use MY money to cover for my mistakes.

    In Ohio, we had a storm in September and we had our roof replaced. We received the check $13,000 to replace it but had to send it back to BofA endorsed by us so that they could endorse it and send it back. Well, that's been weeks ago. They said they would release the check when the inspector inspected the roof - weeks ago. We found out yesterday that they haven't even set up a time for the inspector and the roof has been done for weeks! Our roofer is waiting for his money. The fact that this check has to go back and forth is just ridiculous! This roofer should be getting interest on not being paid the money that he is due.

    I set up "auto-pay" with the Bank of America so that I would NEVER be late with a payment. I set it up that way because I have been hearing all sorts of horror stories about credit card companies just waiting for you to be late and hiking your interest payments to an amount you are just unable to afford. Well, much to my surprise, after I set up my "auto-pay" via Bank of America, they created a pay date that is 5 days overdue! When you set up the auto pay, you can only check, yes, sign me up for auto pay with a payment amount of $**. You are not able to select the date you want it to deduct. I have attached a copy for your review.

    Additionally, one would assume (now I know never assume) that it would default and/or be the due date! Never in my imagination would I think that a company would default to a date that would make you late! I am completely unable to change the date. Customers do not have access to that feature. Well, as you can guess, they have decided that I'm late and then my interest should now be 28.99%. My rate prior to the auto-pay was 10.99%. I called them today and spoke with over 9 people, and have been on the telephone in excess of (4) four hours!!! Instead of accepting responsibility for the error, they just keep offering me unsecured loans at ridiculous rates! I did nothing wrong! When I try to obtain people's names, I am given fictitious names.

    When I asked why they would not provide me with last names they stated that they did not want to give real names! The names I did receive were as follows: 1st - Would not give any name; 2, Will - no last name, 3. Nathan **; 4. Daine ** (will not give last name); 6. Sarah, - no last name; 7. Jeffrey, online services who agreed that this is a problem but could not help me; 8. Heidi ** (no last name). Also, the last person I spoke with would not give me a last name. In exhaustion I stated; 9. Kirisa will not give last name; and finally 10 Dorothy "prefer not to give last name." I'm curious as to why I have had to give all of my personal information to 10 people, i.e., name, mother's maiden name, social security number, account number, income, etc. to 10 people who will not give me a last name???

    Although the online department stated that this is a problem, they stated that they were unable to help me rectify the situation. The online number is 1-866-797-8479. Therefore, at this point I am unable to change my interest rate. I am a single Mom and have always paid on time. I have been a Bank of America customer for I think min. 17 years! In all honesty, I feel that this is a pure and simple "SCAM". Customers are so afraid of being late they will just allow the company to take the money out of their checking account monthly due to the recent problems with the economy. Customers would never in a million years suspect that the company would allow the auto-pay to be late! Please, if not just for me, please help the people that always pay on time not be extorted by these companies. I have never been late until I set up the auto-pay.

    I have had a checking account for over a year and have recently been receiving numerous overdraft fees. The bank will clear bigger items first so that they can charge you more in overdraft fees. Also, they are charging overdraft fees on pending transactions and money that is available in my account. I have had so many issues with them in the past two months alone. In one instance, I made an ATM deposit and a month later they debited it back out of my account saying that they couldn't find the deposit. That's funny because the deposit was made in cash and the ATM is high tech that it counts the amount for you!!! I am so tired of this bank.

    This past week my son accidentally overdrew his account (I am on the a/c with him) in the amount of $14.10. This was caused by three small purchases using his debit card. His account was charged three overdraft charges of $35.00 each for a total of $105.00 in charges. I felt that the charges were excessive and called the branch hoping to get at least some of them refunded. Karen was clearly not interested in anything I had to say and was quite rude through most of our conversation. I told her my son was just out of college and not yet working and she replied that maybe he wasn't responsible enough to have a debit card!

    This Campus Edge account (including debit card) was suggested to us by the branch manager over four years earlier when my son was leaving for college. During the same conversation, I asked Karen if we could request that purchases be declined if there was not enough money in the account and she said no. So apparently Bank of America wants you to overdraw your account so they can charge you these huge fees. I just don't believe that a system that can post your debit on your account immediately can't decline it if you don't have enough money in your account. I also tried to get help through their online help services. The response was, "We're sorry for any inconvenience this may have caused you."

    Since I feel that Bank of America can no longer serve me in the manner I want to be served my family and I have decided that after over 15 years we will be closing all of our accounts by the end of this year. That includes a number of checking accounts, and IRA and investment accounts. My extended family plans to do the same. We believe there must be other banks out there that are a little more interested in their customers.

    This bank allowed someone to steal over $73,000.00 from my VA direct deposit account. They were abled to change my security question and answer, close and open multiple accounts, ATM withdrawals of $999.00 several times in a day and then daily. I demanded the return of the money but only have received $8,800.00 so far and they said they will not give me any more money. I have been evicted, lost everything. I am a 62 year old Vietnam Era Veteran getting 70% service connected PTSD compensation per month. I have not slept yet for days. In so much pain. I have an attorney working for me, but they are giving him and the OCC a hard time. I even have my US Senators office working on this but Bank of America CashPay refuses to budge. HELP!

    Wachovia, which was US Bank if anyone remembers, is just as bad as US Bank was. I have been banking with two top financial institutions for YEARS - USAA Federal Savings Bank and Pentagon Federal Credit Union. I had a problem in the past with US Bank taking weeks to cash Penfed checks. But recently, Wachovia is exhibiting the exact same crap. My landlord uses Wachovia and my second month check, Wachovia took almost 20 days to cash the check. I went into the branch and they had no idea why it took so long to cash but they had credited the amount to my landlord's account.
    Recently, they returned a check for my rent when there was over $20,000 in the bank account (and this is the first check I had ever bounced in 20 years). I checked my USAA account and the money was never taken from my account.

    I deposited my (government) paycheck in my checking account 10-31, the same paycheck I have had for the last 5 years biweekly. They put a hold on it until 11-4. They returned all my creditor checks I mailed and charged me $35.00 per (7). My branch (that have known me for 15 + years) could only return 1/2 of the fees. It is very strange that Bank of America designates weekends and holidays as due dates on credit cards but they don't return the favor of using the same as hold days on checks.

    Bank of America put stop credit on my account by my request. They did this because they said I had a $500.00 charge that I did not have copies of. Finally I got the statement an unauthorized individual in my company used the card. I was disputing the charge until I could verify what the charges were. Finally they faxed the bill to me and paid BA in full. However BA wanted me to pay late charges. I refused since I could not access my account online due to the stop on the account. They could not seem to fax me a copy of the statement. BA agrees that I contacted them, not the other way around and that I stayed.

    Now Encore a collection agency is texting me on my company cell phone attempting to collect on late fees. I am incurring text message fees and long distance charges on my cell phone at work. I have repeatedly asked this company to stop calling me as the late fees are not valid and I will not pay. I have received $47.60 in fees on my cell phone in November from Encore. In October I receive $89.00 in charges for long distance. In November to date I have $47.00 in long distance and text messaging so far.

    Over the last two years, I have seen Bank of America charge a friend of mine over $3,000.00 in returned check charges. He is mentally disabled and has his SS check deposited in a savings account. He has been allowed to open a checking account despite the fact that I have told him that he can not handle a checking account. Therefore, he writes checks when he does not have the money in his account and they charge him $35.00, two times for every check he writes. They have taken his whole check for bad check fees for the months of August, September and October. Just these three months total over $2200.00 in check charges. I have spoken to them until I am blue in the face about his illness. He has no money for the necessities of life like food and shelter as Bank of America is getting their pound of flesh for allowing him to have a checking account even though they have been apprised of the situation and it has happened on more than one occasion.

    Last year I had to give him over $1200.00 to keep them from sending him to Chex Systems. They are non-caring, insolent and rude. I have changed to the Suncoast Federal Credit Union because I have experienced this first hand with my friend. We need a class action lawsuit. Who agrees? This bank needs to be exposed for their practices. This man is bipolar - he has extreme highs and lows. He is not responsible when it comes to handling a checking account. This has been explained to them but they do not care. They keep leaving the account open. In my opinion, they do it to collect the fees.

    I am a student from South Africa and did some holiday work in Boston during December 2007 and January 2008. During January 2008, I opened an account with the Roslindale Branch of Bank of America. I was issued with a Check Card but not an ATM PIN. I told the consultant that I will leave some money in the account on my return to South Africa. I was told that I can request a wire transfer to my South African Bank Account at any time.

    For the last three weeks, I am trying to initiate a wire transfer, but the service from Mary is absolutely terrible. At first she said I must send her an original certified letter requesting the wire transfer. She confirmed receiving my letter via courier but then told me that her boss does not want to approve the transfer. I made contact with the Wire Transfers Department of Bank of America who told me to request a specific form from Mary, to complete the form and send it back to Mary. She must then send the form through to the relevant department who will process it and I will then be able to get a Telephonic PIN to initiate a Wire Transfer.

    I requested the form from Mary last week Tuesday and gave her my Fax as well as E-Mail. Needless to say I have not received anything and when my father called the Branch an hour ago and was told by Ian that they will send the form immediately. Still nothing! What am I supposed to do. I did everything that was required from me, but Mary just ignore me! Can somebody please help! I am taking up a position as a teacher in London beginning of 2009 and need the money urgently for air tickets/visa etc.

    Bank of America designates Saturdays, Sundays and holidays (when postal and banking services are not available) as due dates on credit card accounts in an effort to unfairly generate fees and interest. I feel this to be an unfair practice used to manipulate accounts to generate late fee charges and additional interest. Normally, I pay my balance in full each month and on time. With a Sunday due date, my payment was not received until Monday. Result: a late fee and a full month’s interest plus additional interest for the following month.

    I deposited a rather large sum of money into my checking account. It was in the form of a check, from a rather large and prestigious company. The check was held for 10 days. I was told that this was to allow the funds to clear. This was money that I was using to pay bills. Because checks and automatic debits were scheduled, I was charged seven (7) NSF charges at $35.00 each.

    I live paycheck to paycheck. I use bill pay thru BofA. I went online to check my account, got the balance minus what they had pending and made sure i had enough to cover everything with a few dollars left over. Well a bill pay came thru that I thought was paid out so instead of everything clearing the way it was when I checked online they put thru larger payments first then charged me overdraft 2x instead of 1x. Now keep in mind all items CLEARED on the same date. This is how its always been with them. Now I do admit my account hits overdraft more often than I would care to admit but every time BofA clears these items and charges me way more overdraft fees that should be because of the way they clear items out of your accounts. To me it's not fair but for now I cannot afford to change banks. What do you do? And when you use bill pay and have your items set up for certain days, they change those dates to make payments come out earlier even if the money is not there and charge you overdraft fees. I have have paid so much in overdraft fees I couldn't even begin to add up.

    I have been receiving Social Security Benefits since 1988. I opened an account online with Bank of America for the purpose of having my benefits directly deposited to the account as well as paychecks from my part time job. On October 3rd, 2008 my Social Security check was to be deposited into my Bank of America account just like always. I had no reason to think that it was not going to be deposited, so I started to make purchases with my Bank of America Check Card and by writing a few checks. When I went online on Monday October 6th, 2008 to pay my electric bill, I saw that I was more than $50.00 overdrawn.

    I looked and my Social Security Benefits had not been deposited into the account as they always have been before. Social Security when called advised that they mailed me a letter on OCTOBER 3RD, 2008 advising me that my benefits had been ceased, even though there is an appeal pending. (I received the letter on October 10th, 2008.) My checks from work were not to be posted until that Friday the 10th and I could not stop the direct deposits. Upon calling Bank of America and advising them of the problem and requesting that the account be closed, was told no, they wouldn't close the account.

    Every check and debit card transaction was presented over and over and over and over each time resulting in a $35.00 fee. Bank of America has taken over $800.00 in fees out of my account since October 3rd, 2008. When calling their customer service line was advised by four different representatives that they would not refund any of the fees. Now I have lost everything I had in pawn because I was unable to pay the interest to renew the loans.

    My power, water and phone have been shut off (I'm on a library computer.) My house is in foreclosure, have no food and am going to be homeless in winter in Montana. I was on Social Security Benefits due to a childhood brain injury and am not able to advocate for myself.. There will be no recovery for me and have no choice but suicide.

    On Saturday, November 1st, my son purchased a new tool at a store for $154.04. The salesperson inadvertently debited his card for $254.04 which he voided immediately and debited the correct amount. Bank of America took the $254.04 AND the $154.04 amount out of his account which caused his account to be overdrawn. They then charged him 2 $35 NSF fees. Even though the $254.04 debit transaction was voided immediately on 11/1 by the store, it took Bank of America until 11/6 to put the $254.04 back in to his account. There is no trail on his online banking though, they just cancelled the transaction which now shows his account as never being overdrawn but the $70 in fees are still taken out of his account. I called Bank of America in Chatham on Thursday to speak to the manager about getting the fees reversed but the teller told me he was out of the branch for the day. I went there today to speak to him in person but he was with a customer. I left my number but he never called me back. I went online to the customer service and chatted live with Moss from India who was able to reverse the fees for me. Tomorrow my son will be closing his Bank of America account!

    On a $7.00 overdraft, my daughter was charged over $200. in fees in just a few days without notice. The transaction causing the overdraft was pending according to the bank and that's why it wasn't posted on her online banking. So, since she does her banking online, she had no idea there was a problem until the fees accrued exponentially. She went to the branch and was told nothing could be done about it. Being a college student, this is her first bank account. I feel she has been taken advantage of and abused as well as ripped off by this bank practice. Have there been other complaints about the B of A fee practices and how they take advantage of innocent teenagers?

    Customer Service through Bank of America should be renamed Customer Disservice. The Bank offers absolutely no flexibility with people who live paycheck to paycheck. I was never in the habit of racking up overdraft bank fees until I started regularly using Bank of America. Most banks will allow you to transfer or deposit funds to cover any overage and not assess a fee if the transfer is made same day. Not the case with Bank of America. If your account dips under even for one second and you don't catch it, BAM! $35.00 late fee. For people that live paycheck to paycheck, this is NOT the bank for you!

    I was drawn in by the supposed ease of online banking but there are no ATMs or physical bank branches in my area. I cannot even deposit money through another bank's ATM (Bank of America doesn't allow it). In order to transfer funds from another account online, there is a TWO-day window. Which means even if I WERE to catch an overdraft before it happens, there is no way I could actually get the funds into the account without driving over 100 miles to the closest branch. Some banks offer real customer service. Use one of those. DON'T use Bank of America.

    I had an Equity Loan with Wachovia in 2006 and I got sick and was hospitalized for over a month - during this process my home was foreclosed on the mortgage loan was with GMAC with the 2nd mortgage with Wachovia. When the home went into foreclosure while I was hospitalized when I was only 2 months being on my mortgage and it was sold on the courthouse steps however, the buyer did not pay off the 2nd mortgage even though there was over 23,000 equity in the house and the balance owed was only 106,000 and the 2nd mortgage was only 8,000 - the realtor that purchased the house did not pay the second mortgage. I am now being sent notices from Wachovia's collection agencies regarding payment of the 8000.00 which should have been assumed by the purchaser of the foreclosed home.

    The same week the house foreclosed I was still in the hospital so my son went to Dalton to meet with the real estate agent that bought the house to make arrangement to get my furniture out of the house. He secured a moving company to pack and move my furniture to storage and when the moving company arrived, packed the furniture after receiving the invoice, we discovered the real estate agent had moved all the furniture out before the moving company arrived and only left a dining room table and 4 chairs and a china cabinet along with clothes and misc. items.

    We had prepaid the moving company 2700.00 to move 3 bedrooms, living room, computer room and breakfast room and kitchen which the realtor had already moved out within 5 days of buying the foreclosed property. The neighbors took picture of the realtor, his wife and father-in-law moving the furniture out prior to the moving company arriving. I moved to North Carolina after getting out of the Hospital and constantly being sent letters from collection agencies regarding the 2nd mortgage. I informed Wachovia of the situation with the 2nd mortgage but they continue to call and harass me. Do I have any recourse regarding this matter? I am a widow on a fixed income and cannot afford to pay 8000 for a loan that should have been attached to the foreclosed property.

    I am a college student that had gone to Wendy's drive-thru one night for a meal no more than $10 and charged it to my Bank of America Debit card. This transaction was made at 12 midnight during the beginning of the month of June on 183rd Street in Skylake Plaza, North Miami Beach, Florida, which is a city over from mine. The following day, approximately around 9am I received a text message from Bank of America stating that my balance was lower than it was supposed to be, so I checked my online banking. Apparently someone used my card at a gas station for the amount of $67 at 2am at the Skylake Plaza gas station.

    I had cancelled my ATM card and received a new one. During this time I had plans to go to New Jersey for the month of July, and when I had asked to have any other information forwarded to my mother's address in New Jersey, they stated that there was no way they would be able to forward any mail to my temporary address. During this time, I had already contacted the manager of Wendy's but she did not take any action whatsoever.

    When I was on the phone with B of A claims, the woman did tell me that I could file a police report, but B of A would more than likely file their own report and credit back the money into my account. I had/was reimburse right away, and had received my new B of A card before leaving to New Jersey, but did not receive the affidavit form that the bank had wanted me to fill out. During the following month, while in New Jersey, I noticed that B of A had taken the money back from me. I had called and asked them why, they said that the reason was because they had not received my affidavit form, and after the report had been received I would be once again reimbursed.

    Once I returned, I had filled out the form and faxed it to them the following day, telling me that they would give me a call back from the claims department within 10 days after the form was reviewed. I did not receive any confirmation and two, three weeks passed and I still not had heard back from them. Once again, I contact the claims department and they e-mailed me the copy of affidavit, and I faxed it, this time receiving a confirmation number. Another three weeks pass by and no response from Bank of America. By this time it was September and B of A reports that the status of the claim still had not been processed and tell me to wait another 10 days.

    Once again, another two to three weeks pass by and I call B of A. It was the beginning of October and I had spoken to Diego. I ask Diego what is the status of my claim and he reports to me that my claim had been denied. By this time I was furious and ask him when was this decision made and why had I not been called or informed about this. He said the claim had been denied the 3rd of October 2008, and the reason why was because they did not find any fraudulent charges. I ask to speak to his manager, and he transfers me to Shannon. Shannon reports the same thing that Diego did, and I ask them why I had not been contacted and criticize Bank of America for their poor customer service. I ask to speak to someone above her, and she transfers me to her supervisor, Mackenzie. Once again, I get no answers and never received my money back.

    Also, whenever I spoke to the three of these B of A representatives, they gave me different responses, and stated that I even had a "history" with the gas station that the purchase was made. When I asked Shannon the "history" there was only one previous transaction made beforehand, and when I asked Mackenzie, she would not give me a number, but stated a numeral amount. Also I disputed the fact that I am not a big spender at all, and if you looked at my transactions, you will see that even at a gas station or anywhere else did I ever spend no more than $50. In fact, my 2007 2-door Pontiac G5 wouldn't be able to intake more than $50 even during the gas prices at its highest. Also, they stated that since it was a debit card, there would be minimal chances that it was fraud, which I found ridiculous because here in Florida, all you need when you pump your gas is a zip code, and there are a choice of three within my area, where it would not be difficult for anyone within this region to use my card without a pin. When I asked Mackenzie if she would be able to confirm if they used a pin number or a zip code she stated she would not be able to confirm that (?).

    Contrary to everyone on this board I am very happy with Bank of America. I've been banking with them for the past 30 years and I've had one single problem and it was taken care of immediately. The managers are active and aware of problems with customers and I have no complaint. Most of these problems that people have are overdraft fees. I don't mean to be disrespectful but maybe if you kept a thorough record of your transactions and balanced your checkbooks, this wouldn't be a problem.

    It is a common tale. There was about $80.00 in my account. Five transactions posted in a single day totaling around $275.00. They post the largest transaction first, one for $200.00. This put me over the limit, so the four additional posts totaling no more than what was currently in my account all now cost an additional $35.00. I understand that for the day I had insufficient funds. That now costs me $175.00, rather than a mere $35.00 if they had processed them in an order different than highest amount to smallest amount.

    I cashed a check at B of A and paid the six dollar fee, but they can't give me a receipt. How in the world does that make sense. She gave me pamphlet explaining why I have to pay six bucks. I said when I pay for something, I should get a receipt, even when you buy a 25 cent bag of chips you get a receipt. They did not comply.

    I called Bank of America (B of A) on 10/13/08 around lunch time Eastern about consolidating some debt and asked what they had to offer me. I had planned to go through a few credit card companies and then decide on my best offer. The B of A associate I spoke with found an open account, that I was not aware of, and that it had enough available credit line to do a balance transfer so I could pay off all my other debt and I would only have one account to worry about. This was exactly what I was looking to for. After going through all the steps and discussions on interest rates and transaction fees payment schedules it was settled.

    To me I didn't need to go any further. The opened account had a 0% rate for 1 year, and the guy I spoke to was Darrell ** and he said he would waive the transaction fee if I wanted to do the transaction right then and not continue my search for another company. It sounded perfect so we proceeded to go through the bank routing and the final steps and finished the transaction. I never asked that the fee be waived; I was told the fee would be waived because I was considered a good customer. I would have continued to look elsewhere and if no better offer was found then I would have called back and took B of A's offer. The offer of no transaction fee sounded very attractive and I took the offer.

    When I received the first statement on the account the transaction fee was on the statement. When I called B of A about the fee being waived, the associate said they could not waive it or never would. I asked to speak to a manager and obliged and connected me to Leslie **. Leslie was confrontational, degrading and rude. She spoke down to me, asking me, "Does it sound right to you, Mr. **, that a bank would just give you money without collecting a fee?" I said, "It does when your associates tell you that is how it is going happen." She spoke over me and did not listen to me or my complaint. When I finally asked her to let the customer speak, she kept quiet but I felt like she was doing something else and still not listening to me due to the pauses and excuse mes when I asked questions. She said that she would not waive the fee and if there was anything else she could do. I asked to speak to someone else and she said there is no one else. At this point she said if there wasn't anything else she could help me with she had things to do.

    To me this is committing fraud when associates tell consumers one thing to get business, the company does something different against your will, and does not even attempt to correct the problem. I was told at least a dozen times that the fee would be waived and now I am stuck with it. I want to give the money back but I am still tagged with this $1200 fee. It is a scam by B of A and I hope there is something someone can do about this before to many people get burned by this fraudulent business practice. If not this is very easy money for B of A. Has this happened to anyone else? Please help the little people fight the giants since it is our tax money helping bail these giants out of their own mess.

    Someone wrote me a check off their Wachovia account. The amount was $45.00. I cashed it at SunTrust, which is my bank. The next week, SunTrust sent me a copy of this check saying Wachovia sent it back to them because they could not locate acct. SunTrust told me that Wachovia stamped over the account # on check and did not bother to try and pull it up using the name on the check. I was then charged a $10.00 fee because of this. SunTrust has since refunded my $10.00.

    I went to Wachovia twice and they will not verify that it was their fault. When I ask why they couldn't have just pulled up account by the name on check and they replied they only use account #. Wachovia told me I just need to contact the party on the check and have them write me another one. They just did not want to admit their mistake and try to help. As a matter of fact, the young lady told me if it made ME feel better she would say it was their fault in a sarcastic manner. I found them to be very unprofessional and the party that wrote me the check will be moving their account to a bank that is more customer friendly Thank-you.

    On Sat Nov 1st 2008, we went to Wachovia bank as my son who is 24 had some payroll checks to cash. The payroll checks are from my business checking account as my son works for me. There were four checks in all. We arrived when the bank opened and my son went in to cash the checks. About 25 mins later he came out after waiting that long at the tellers window while she counted and recounted the checks for the $900.00. My son came out to the car and informed me that I forgot to sign one of the four checks and would I sign it and come back into the bank with him as he did not want the teller to think he just walked out the door and signed the check himself. So I grabbed my drivers license and went back into the bank with him. The teller he had was busy so we were prompted to the next teller.

    I was annoyed by then as this was already over half an hour to cash these checks. So we got to the teller and my son told her he wanted to cash the check and she asked him if he had an account and so forth. I handed her my license and said to her "Can we please just get this done. This has taken long enough already." So she looks at me and says "Ma'am you don't have to talk to me like that." So I said to her "Talk to you like what? Just cash the check and let's be done." I was getting more annoyed so I left the bank to go back out to my car and wait for my son. He comes out and says to me "The teller wanted to know your name as she wants to report you!" So I said to my son "Report me for what?" She said to my son after I left the bank if I was his mom and what my name was.

    My son said to her "Please just finish cashing the check and give me the money." She said to my son "THAT'S OK. I WILL LOOK UP HER NAME MYSELF. I HAVE ACCESS TO ALL HER INFO." We'll when my son came out and told me she wanted my name and she was going to report me, I went back in the bank this time with my husband and took my license in again to give her my name and see why or for what reason she wanted to report me? She was busy so I went to the customer service rep counter and explained to the rep what had happened and handed her my license. The rep was very nice and told me she would have a bank office call me on Monday. Meanwhile the teller (who turns out to be the Teller manager Bobbie **) comes over to the customer rep counter and I said to her "I came back in the bank as my son said you wanted my name and were going to report me?" So I said to her "for what" and "here is my name."

    She said she did not like my attitude and asked my name and I said "and your is?" She laughed and said "I am the manager and my name is Bobbie ** and do you need me to spell it or wait a minute and I will get my card for you." As she is walking away from the customer service stand to get her card SHE YELLED BACK TO THE CUSTOMER SERVICE REP "CALL 911, I WANT THIS WOMAN REMOVED FROM THE BANK." I was shocked and appalled. I am 49 years old and never treated that way. Never have even gotten a traffic ticket in my life and here I stand a customer in the bank and yelled at by not only an employee but a manager. There was a bank full of customers, employees and I was stunned, shaken and embarrassed to say the least. The rep that she told to call 911 would not even do it. She just stood there in amazement herself.

    When we left the bank I said to my husband that maybe we should stop at the police station and report the incident in case she does call the police. We did stop and speak with and office - Corporal Brian ** and he told me that he would write a report but that I she called the bank on Monday and speak with him. He also told me he has been there all day and he never got a call from the Bank. I feel this manager abused her rights many times from first telling my son (who is not a child, he's 24) that she would look up my name if he would not tell her, then yelling in a bank full of people to call 911 and have me removed. I am very upset about this...

    I opened my checking account online. I had just moved to Texas and am staying with a relative until I find a place of my own. Wachovia closed the account on October 15, 2008 without notifying me because they claim they were unable to verify the address I gave them. On October 20, 2008, I deposited my last paycheck from my previous job. At this time, no one told me the account was closed. The teller who performed the transaction was unaware that the account was closed. At the time of my deposit I was told I would have to wait until October 29, 2008 to draw on the funds. That was acceptable. During the next nine days, no one from Wachovia bothered to contact me in any way to tell me the account was closed.

    On October 29, 2008, I attempted to pay a bill with my account, since I had not been informed it was closed. NO ONE FROM WACHOVIA HAD BOTHERED TO CONTACT ME!!!! The electronic check was returned, account closed. I contacted the local Wachovia branch and finally learned the account was closed. After an hour on the phone, I spoke with loss management and learned what documents they wanted to verify my address. I had to actively seek out the answers insteads of them doing their job! Now, I am waiting still two days later to get my last paycheck credited to my account. Wachovia has been collecting interest on my money for twelve days and it is just too hard for them to do their jobs and credit it to my account. It should have been done immediately, not put in line with other transactions. NO ONE AT WACHOVIA WILL TAKE THE RESPONSIBILITY FOR WHAT IS THEIR MISTAKE!! The loss management department did not do their job and contact me.

    My checking account seemed to be in the red all the time, no matter how much or how little I spent. I discovered that the bank was being dishonest, and not updating my account information online, or through the ATM or automated phone line. As it turns out, debits are not immediately withdrawn from your account, as such, the bank doesn't feel obligated to update your account information, until the money has actually been paid to the company. Therefore, your account may say $50, but since you just spent $30 at a restaurant, you really only have $20. Then, when I would overdraft, I would be charged a $35 fee.

    I repeatedly called and questioned the practice, and requested again and again detailed account statements. I started to notice that not only was this happening, but the bank would often wait to assess the overdraft fees until they reached a point in which the fees I owed were higher than my account balance, which would again put my account into the red. There would be no warning or message that my account was overdrawn, despite having signed up for text notifications of my account status. I would think I had money in my account, buy a $2 cup of coffee, and be assessed a $35 fee.

    In one trip to a coffee shop, I bought a coffee, and then decided to get a doughnut, because these were two separate transactions, I was assessed a $70 penalty, for a coffee and a doughnut. I was eventually directed by customer service to speak to a representative in person, so I chose the Milton branch, because I happened to be driving by. I stopped in, and was informed that due to my frequent overdraft charges, which at this point equaled a few thousand dollars, I was not eligible for overdraft protection in the classic sense. He could set me up with a line of credit, and as he stated, this would prevent the $35 fee, but the charges would be subject to a substantial interest charge 19%, because of my history.

    After doing some math, this would still save me a lot of money, and the credit account was fee free he said. A few weeks later, I received a credit card in the mail, which I wasn't expecting. I continued to use my debit card, and was shocked when I got my first bill. Not only was I being charged for the amount of money I withdrew, I was still being assessed the overdraft fee of $35 and now I was paying interest on this fee. I called customer service many, many times, only to be put on hold, or yelled at. The representatives all told me the same thing, it is my responsibility to keep track of my funds, and it's my fault I didn't understand the contract I signed. I have never received any explanation as to why they lied, even from the man who originally sold me on the line of credit, and to this day, I am stuck with a Bank of America account, because they won't let me close it unless I pay off all the fees, which I refuse to do.

    I noticed a number of discrepancies documented on my B of A account in a recent credit check, so I wrote a letter to Bank of America. I informed them that I had entered into an agreement with Bank of America on or about November 2001, whereby a monthly payment would be sent automatically from a Debt Consolidation program and no further activity would take place on the account. Accordingly, no fees would accrue either. While there may have been a delay in the first payment being sent, the account shows a consistent history of past due payments beginning in April 2002 and continuing for several years. I requested that they please investigate your records on this matter.

    I received a response from Kristy ** that, "We will no longer respond to the issues listed in your most recent letter (?)". I was flabbergasted and wrote back, certified this time, "I am very concerned with a recent letter from Kristy ** on October 23, 2008, stating that B of A was required to accurately report the status of all accounts, but would not consider investigating your own inaccurate reporting." Has anyone had any luck in a similar experience? Interestingly enough they will not even include an address on any correspondence. I had to call and get an address for the Customer Satisfaction Department...

    How is it legal for a Wachovia to exact NSF fees for transaction that should have been covered by your account balance as in this example: Balance $200.00. 5 Transactions hit account on the same day, $50, $50, $50, $50, $1. WACHOVIA takes that as: Balance was $200, Withdrawals posted = $201. Number of transactions = 5 = 5 NSF FEES!

    This is how it was just explained to me by the bank manager at one of their locations while I fought to have their online statement explained to me as to why I incurred so many overdraft fees! According to my account history from Wachovia.com, they withdrew $70 from my account the day BEFORE 2 charges posted. With the $70 IN the account, it would not have BEEN overdrawn. They shrug it off, saying their website isn't accurate. Wachovia refunded half of the $210 NSF Fees and completely ticked this Customer off at their obvious immoral actions (bordering on Illegal if you ask me!).

    I was just charged $315.00 for overdrawing my account by $13.45. To me this is a complete rip off. I work for a bank and have previously worked in customer service. I completely understand bank's wanting to have a system in place that keeps consumers from taking advantage of them. But I don't understand how it is ethical or even legal for a bank to charge me ridiculous amounts of money based on arbitrary posting procedures designed to screw me in the first place.

    I made a cash deposit at an ATM on a Saturday morning and made several small transactions after this. Seeing that I was going negative, Wachovia's systems posted my debits before my credit, in addition to withholding items from my available balance so that I would overdraw even more. For a total of nine items that added up to $13.45, I was charged $315.00. This is a pathetic shame. And the only thing representatives could say is that I need to be more careful with my money. This is an ironic statement for a bank whose apparent over-extended payroll line of credit has caused them to require an emergency buyout.

    On Oct. 29th, I went to Bank of America to cash a check (business check no less) that was written to me and drawn on Bank of America and the teller asked me if I had an account with Bank of America. I responded No? She then proceeded to tell me that there will be a $6 charge for cashing the check because I am not a customer? $6. That's more than what Stop & Shop or the Check Cashing place charges. So here is what that means. If you are a customer of Bank America, you're probably already paying some fees for keeping your account, etc. You write a check to someone and Bank America takes $6 of your and puts it back in their account. DON'T WRITE CHECKS TO PEOPLE UNLESS YOU KNOW THAT THEY WILL DEPOSIT IT IN THEIR OWN BANK. YOU WILL LOSE YOUR MONEY TO PAY FOR THE BANK FEES. This is just one more thing the banks can do to squeeze money from our pockets. So very sad! What they are saying is you either become a customer or you suffer.

    I check my balance everyday online and noticed I was charged 3 NSF fees. Here's the deal. I have money in my savings with overdraft protection. I knew I was getting close and figured they could just transfer money from my savings to cover any checks/purchases...which they did. No problem...other than the fact they charged me NSF fees for them. WTF? I had the money, I knew my savings would cover anything that came in... Isn't this what they advertise overdraft protection for??? So I go to the bank and the supervisor tells me that it was some debit card purchase I made that they somehow authorized a 'hold' for. Huh? It does not show up anywhere... could have been anyone and I'm responsible???? I don't get it. Now if that doesn't sound like some made up BS I don't know what does! She reversed the $75 for me because I think SHE knew it was **! This is ridiculous and it seems they are just trying to charge these fees and see if the customer notices and makes a stink about it. What a bunch of crap!

    I phoned and mentioned that two different companies under Trilegiant had been charging my card for over 4 months. After endless phone calls and stating that I was going to the State's Attorney's office with my findings, B of A was able to speak with reps at both businesses. TLG Great Fun and AP9 VS Home. I was unable to reach any contact at TLG and VS Home only refunded me one month. Then I got nasty with B of A, warning them of my knowledge of their affiliate, Trilegiant and it's fraudulent behavior. I got further help, but not without hang ups, and long phone wait. I believe that B of A makes a percentage from these fraudulent charges and when the consumer goes over his/her credit limit because of them, B of A tacks a $39 charge, knowing that this will happen, because most customers don't assume they are being fraudulently charged creating an overlimit!!! I believe that B of A needs to be prosecuted for it's theft.

    Bank of America is a fraud. They have set up my account to where I can never get accurate information of my account balances. On top of that, the bank will hold a transaction that you make at an ATM. Meaning, if I withdraw money out of my ATM, my account will not reflect that. They will hold the ATM transaction until you have made a card transaction and then BOA will take out recognize your largest transaction instead of the order of which you made them including ATM transactions. This is fraudulent. What can consumers do? I have read page after page of complaints about BOA and their agenda to charge overdraft fees. We must do something about them. I volunteer to become the leader to organize consumers who want to see Bank of America return customers money that they have wrongfully taken.

    I've used online banking since online banking arrived. I've had a Wachovia account for 3 months now and have incurred around $900.00 in NSF fees in this time. I check my balances online daily. I check them via my phone and the atm and never once did I show a negative balance. Things would be on hold but they were not more than the deposit that might be on hold. Then suddenly I have no money in the bank and I AM negative because a mysterious NSF appears even though the balance is positive and until the NSF fee was NEVER negative!

    I ask and they go through this lengthy description of how this that and the other hit before this deposit etc. and can never answer my question. If nothing shows me to be negative and my outstanding debits do not amount to more than outstanding credits, how can I get an NSF fee which then really DOES send me negative? I can get no relief to this. Because of this loss of $700, I was unable to put a down payment on a vehicle since my vehicle's transmission went out and had to borrow my friends fishing truck for work, my mortgage payment bounced and now I must pay only with a money order or cashier's check for which I'll have to pay a fee.

    I went to cash a paycheck from my part time job for $25.00 (since it was such a small amount I did not deposited in my checking account with another bank of course) and when I received the cash it was only for $18.00 and change and I was told by the teller that there was a $6.00 fee for not having an account with them. I was not even informed that I was going to be charged for this amount prior to cash the check. Nice way of forcing people to have accounts with them. Will never do.

    Somebody needs to investigate Bank of America's policies on tactics involved when charging customers overdraft fees. This is a huge source of revenue for Bank of America and they are unethical and wrong in many of their judgments. They don't recognize transfers online when they occur. I have been a customer for many years and it's surprising how I have been treated.

    All I can say is that Bank of America is horrible, thankfully I don't bank with them but my boyfriend does. They ruined our vacation, that's all I can say. Basically, we were on a cruise and we ended up in Cozumel, Mexico. We went on an excursion and we had to pay. Well, my boyfriend realized he did not have cash on him and when he went to the ATM to take money out, it got declined. Well, then we said, "Let's go call the bank"... We call them and basically they said that they could do nothing for us. We had no cash on us at all and we had to pay for our excursion. By the time we got a response from the bank that they could do NOTHING for us and we could not get access to his own money because the bank cancelled his card, it took us over an hour to get that answer.

    Why did it take over an hour because 1) We got the runaround and transferred all over the place and 2) we would get hung up on when we got transferred, all to get the answer NO, they couldn't give us the money. And the excuse they gave for cancelling his card, another joke... some excuse about a third party having a compromise on his card that happened a year ago. Well, long story short... my boyfriend tried to go back on the ship to get a loan or something... and that's a whole other issue...

    I ended up being stuck alone in Cozumel, Mexico with NO MONEY and just my ID and my SeaPass for the boat. We have a whole other issue with Royal Caribbean because they would not allow my boyfriend off the ship and they promised him that they would find me. They never let him come along and they basically assaulted him because they were holding him back with force for absolutely no reason. My boyfriend is not the violent type and they had no reason to push him around and hold him back. Well, anyway.... My boyfriend ended up paying $1200 (he got the money somehow with some help from people on the ship) to get me from Cozumel, Mexico over to Belize. I BARELY made it and we were reunited again.

    It was a horrible experience that I would NEVER wish on anybody. We were not separated on purpose or because wanted to... but either way... we lose out. Neither Royal Caribbean nor Bank of America will do anything for us. I'm more pissed off at Bank of America for just cancelling his account just because and giving us a lame excuse as to why they cannot refund us the money. And we have a receipt proving that the $1200 was paid. It was just ridiculous!!! Just thinking about it is upsetting. I heard some bad things about Bank of America... but this has been the worst. In an emergency, they supposedly can't do nothing for you... and they just decide to cancel his account right around the time that we are on vacation in a foreign country. ** That's all I can say... **.

    I am being charged fees on top of fees for overdraft when I put CASH in the bank. I can't overdraw 20.00 or they will charge me 140.00 for 4 overdraft fees for pending transactions of which were covered. The one that wouldn't be covered is 20.00 which I could see them charging 35.00 not 140.00.

    Every so often, money disappears from my checking account. The balances are all changed, so it looks like nothing happened. This money is returned about a week or two later. This time, however, it was nearly all of the money I had in my account. It wasn't so much to sue over, but not little enough not to care about. I contacted BOA online, and they told me it was a bank error that would be resolved that day. Nothing happens. Call them the next day. Of course, the associate needs all sort of info, and I'm looking online at my account, but I'm flustered and told to call back with more info. The next person magically doesn't ask all of these questions, but doesn't help much and suggests that it has to do with one of my pending transactions.

    Next day: transaction went through, balance the same. Later that day: Completely forgot about a purchase that I had made when I had money in my bank account, which now puts me in the red. Contact them online again - this person is very stupid and doesn't understand anything though I kept saying the same stuff over and over again. Suggest I call them. So I call again - and this person finally does something - decides to credit my account with an old overdraft fee that I had paid, so I wouldn't be in the red. Money is still missing, though. It wasn't me, it wasn't identity theft, it was the bank. I am seriously thinking about switching banks.

    How about Bank of America holding a student loan check, funds clear the bank written on October 14, 2008, but Bank of American claims that the bank written on is claiming check is fraudulent, the bank it is written on says that that is not true. They will not give me any more information, they will not talk to the bank check is written. Meanwhile my account is on hold pending closure with a whopping $3195 student loan that I have no access to. PNC will not write a letter stating the check cleared unless they speak to Bank of America, and Bank of America will not speak with PNC because they do not speak to third parties. Talk about Catch 22. I am a single parent of two school age kids, any checks written on this account were charged overdraft fees.

    Every time I call its toll free number, I must repeat every word I say several times even though I speaking in the most clearest voice I have since I have a speech problem. When I am finally able to be connected to keypad system of using this method, it occurs after I have wasted 15+ minutes of repeating myself and became flustered for doing so. This bank is breaking federal law governing such matters concerning voice response answering systems. According to that federal law, all automatic answering systems must be set up to say that particular option or press a certain number for that option from the start of each telephone call it receives.

    I, for one, have repeated myself for the very last time while I was trying to use its telebanking system. In addition, I have made the repeated request to have all of my banking information to be completely removed for its site since I am unable to log onto for the simple reason it will not recognize my password. It has not yet honor this repeated request. It will only do two things. One, it will send me E-mail to inform me someone was tampering with my online account even though I was that person and I am the only person who access to my checking account information.

    Two, it will play the blame game with me for not remembering my password correctly when it is the same password I use anything that calls for a password while I am online so I could I forget my password??? This bank does not care about these factors or any other factors since it purposely tries to make its customers' banking needs as difficult as possible all the while it is claiming to have been rated number one in customer service for seven straight years. From what has happened to me and what I have read on this site, this bank must be conducting business in La-la Land. Come October 31, 2008, I will be changing banks since I have had enough of this bank's BS to do me for a lifetime.

    I recently left Wachovia Bank because of many issues. One in particular was overdraft fees. Everyone has overdrafted at least once or know someone who has. But I bet money that no one's account was closed without notification and reported to a collection agency---unless it was with Wachovia. And that is exactly what happened to me. I have since left and am now banking with a prestigious company who values its customers and don't seem to have their hand in my pocket. Please be careful if you are considering Wachovia as your bank. And if you decide to go with them, apply for a bank account elsewhere in addition.

    From the beginning I thought I had overdraft protection. It seems that I did not so on or about 10/10/08 I entered the bank and applied for an overdraft protection on my checking account. It seems that it wasn't applied to my account and now I have been charged over $300 in overdraft fees in a 2 week time period. I entered the bank today, spoke to the branch manager and she wasn't very helpful. I contacted Teresa via phone, a bank representative and explained my situation to her under the false pretenses that I have this overdraft protection on my account. She was kind enough to return a courtesy $119 back to my account and put it under investigation. Obviously as an unsatisfied and disappointed customer I need my full refund back, NOT partial...

    My daughter's checking account became overdrawn after a series of $3 and $4 dollar purchases. By the time she became of aware of it, Bank of America had a total of $650 in overdraft fees charged to her account. Her purchases amount to less than $100. I called customer service. My question was: "why do you not simply REFUSE THE CHARGE?" This is where it gets interesting. The rep had a convoluted tale of money appearing and then disappearing out of the account, due to merchants' delay in finalizing transactions. In essence, she said the Bank did not 'know' the account was overdrawn, so they honored the charge and assessed the fee.

    How could the Bank not 'know' the account was overdrawn? They are the ones who knew first! They are the Bank! They are the ones who sent 6 overdraft notices on separate days!

    My conclusion? The Bank does know. It is their job to know. Of course they know. But they look the other way and honor small charges to overdrawn checking accounts, then collect a king's ransom in fees at the end of the sad story. The Bank knows what it is doing. This is no accident. It is a pattern of deliberate and repeated abuse of consumers and betrayal of customer trust. In essence, Bank of America processed a series of unauthorized $3 and $4 dollar loans at 100% interest to my daughter.

    What is most concerning to me is the customer service rep's final statement. In an unguarded moment, she let it slip that the Bank could actually charge up to $5,000 in fees without any legal ramifications. This is very worrisome since the BANK is in charge of the very transactions and their timing, which apparently is excruciatingly precise and perfectly sequenced EVERY TIME to result in a $35 dollar fee. This is just too coincidental. I believe that Bank of America may be up to some pretty dirty tricks, and they may be playing these tricks on those consumers who are most vulnerable and least likely to protest: the young, the elderly, the disabled, and those whose first language is not English.

    Think about my daughter's story: $650 dollars in fees for $100 in purchases. Now multiply that by a million customers. That's $100 million dollars the Bank churned out in pure profit for itself, simply by preying on naive and unsuspecting customers. Now think about this: Bank of America is the SECOND LARGEST Bank in the U.S. They certainly have more than a million customers. It is reasonable to assume that they probably have over 5 million customers.

    Dirty tricks? Bank of America may, at this very moment, be cashing in NO LESS THAN $500 million dollars in unjustified and exorbitant fees! That's HALF A BILLION dollars folks! My only question is this: when is our government going to launch an investigation into this pattern of abuse and victimization? How long will our elected officials continue to look the other way and tolerate a Bank that robs people?
