Bank of America charged me an overdraft charge ($35), but according to my online banking ledger my account never went negative. I called to clear this up. Tammy from Rio Rancho contact center told me that what I saw on online banking does not reflect the money that is actually in the account. Thus, while my account never went negative according to my online accounts, BOA said from their end it did. Tammy was dismissive, disrespectful and frustrated when I didn't understand. I believe BOA is playing with my funds (preventing items from posting on the day or day after they were charged) and is holding money until my balance is low enough to drop the items all at once and incur overdraft charges. Since opening accounts with BOA in June, I have received roughly 25 overdraft charges - many of which posted in clusters or overnight so that I could not protect myself.

A customer of 28 years, I have checking, savings and credit card accounts at BofA. I have usually experienced quite helpful (sounding) service with its agents. In structuring the account spread, I have three times in recent memory attempted to link one of the cards as backup to the checking account. Both times, I was told it wasn't but it is now both at a branch and on the phone. In Dec. '07, I received a postcard stating an NSF transaction, paid and charge to my account of $35. I went to the local branch to have it sorted. The surly operative said, "No, it is not linked and there's nothing I can do about the charge." What? I proactively established this, so I thought, and verified/corrected it at my semi-annual checkup and it doesn't work. Then why was I told it would? As if some joke, half of the notice card is a return not prepaid but requiring one's own stamp with check boxes: I have overdraft protection through my savings account. I have overdraft protection with a credit card and two others re: alerts.
Why is this bank asking if we have such protection when it obviously does not work? Might this survey simply be a scheme by which to obfuscate the bank's own device to scam, under false pretense of having offered a service, the customer out of the fee while pretending either a) not to know of the customer's election for the service or b) that the service is, or should be, in effect for the account but something seems to be wrong with the bank's records/system in either event netting BofA some quick extra cash? Any small business pulling such a stunt would be likely done for misrepresentation or fraud by Cal DCA. (Oh, you did sign up for our special coverage? Too bad it didn't work, sucker.) I'm going to the authorities over it next.

My aunt was the victim of identity theft during the month of May 2007. She was residing in an assisted living facility in Pennsylvania at the time that her Bank of America checking account was compromised. What basically took place was this: someone removed three checks from her checkbook and attempted to cash them. The first attempt was successful, the other two were not. The amount of the check cashed was $35,000 at a Citibank location in Manhattan. This check at the time it was cashed had fraudulent signatures on both front and back, and no thumbprint or driver's license number was on the check anywhere. I have never been told as to how this check circumvented the bells and whistles that are supposed to be in place to prevent such a thing from happening.
I filed a claim with Bank of America to try and retrieve the stolen funds immediately after the theft was discovered at the end of September 2007. Because the theft was not reported within sixty days after the fact, Bank of America respectfully denied the claim. At the time, the theft was discovered my aunt was recovering from surgery, both of her legs had been amputated a week prior due to her diabetes. She was also showing signs of dementia during the summer of that year. My aunt's lawyer was immediately contacted and notified, and proceedings began against both Bank of America and the assisted living facility where my aunt resided. I was told by the lawyer involved that he felt confident of an out-of-court settlement, but now a third party defendant has been dragged into the case, this more than a year after legal action was initiated.
My aunt had no children, no family at all with the exception of myself. She lived in Pennsylvania, I live in Michigan. My aunt's health was very problematic at the time of the theft, her suffering from diabetes combined with the onset of dementia made it impossible for her to understand or deal with what had taken place. Bank of America needs to acknowledge this and respond appropriately. My aunt died the end of October 2008. What assets she did have were turned over to the nursing home where she lived until the time of her death. It is now up to me to pursue this action to its eventual outcome.

Bank of America has refused to send me lost statements or, what I finally discovered was that they sent my November and December statements to me after I withdrew several hundred thousand dollars to another two banks. It took 60 plus emails and I still have not received duplicates of my statements. They did promise they would be coming and I have not received them. I since have inherited a great deal of money in the millions in trust and they are the last people I would consider dealing with anything other than a checking account. I proved they were missing $134,646 from my account when I changed to two banks who backed me in not getting information from BofA. They treat you like crap even if you have had as much as a half million sitting in their banks while deciding how to invest. I am warning people against dealing with their power plays.

My issue with BOA is their apparently random policy of placing holds on deposits. I have a rental property, which I have received checks from the renter for 14 months. Until 4 months ago, everything was fine. I would deposit it in the ATM and it would be credited about 24 hours later, which is fine. They installed those new ATMs that scan the checks and then they started placing holds on the deposits before placing the credit. For example, if you have $500 and deposit $1,000, your balance would show -$500.00! This caused numerous overdraft fees, etc. I talked to someone at the branch in Irving, Texas on MacArthur Drive and he released the hold. He told me to not use the ATM to deposit any more because this had been happening to people.
So this month I made the deposit with a teller, as suggested. The money showed up in the available balance 24 hours later, so I paid about $400 in bills. Later that same day, which was 1/9 (Friday), they placed a hold on the deposit and pulled the money out of the available balance. I know the renter very well and I stopped by to ask him about the check he had written me. He showed me online. His bank account had over $18K in it! So why is BOA placing holds on accounts? For the fees, of course. I went to the bank in Plano at Independence and Custer and spoke to the Branch Manager. He said he may release the hold on Monday. If they don't, I'm closing my 3 accounts and moving somewhere else. No one at this bank gives a crap about the customer!

My father passed away in July 2008 but three months prior, I started assisting him with paying off as many bills as possible. To the surprise of my brother, mother and I, he had requested and received a $30K loan with BOA. When I went to the branch that he used, the branch manager informed my mother and I that he applied for the loan in August 2007 and that no member of our family had co-signed nor did he sign a document in the event of.
Since providing BOA with death cert and the newspaper announcement, they insisted that my mother (age 73) is responsible for the debt or a lien will be placed on her home. Yet, BOA will not provide us with a copy of the signed contract and the interest is still incurring. What recourse does my mother have? I've checked every website trying to find a state of Maryland statue on this. BOA branch manager at the New Hampshire avenue location has not been kind but she is only doing her job for her employer. Could someone provide any assistance or information to me?

I am reading about all the BOA reviews concerning overdraft fees. Well, first of all, they try their hardest not to credit these fees back to us. You would think that they would want to help the average long term customer, especially in these hard times. Well, think again. I have a friend who works for BOA and on their computer screen, there is a section that pops up on their customer information screen and it says: Retention Score - for most people, the score is low regardless if you have been a customer for a week or twenty years.
It is all about how much money you have invested with them and how much money they are making. If you have under $10k at any given time, your score will be low. They get nasty and rude and when you try to complain and talk to a supervisor, they are even worse. It does not matter. All they do is look at Retention Score and they can say/do just about anything they want to. This is great customer service.
I have several accounts with them, and they charged me 4 ODs. When I called them, the supervisor, was so rude that I told her I wanted all my accounts closed. She then replied, "Sure, no problem." Well, long story short, after closing the personal accounts, I then proceeded to put my fiance on the phone to close our joint account. She (supervisor) told my fiance the same thing (no problem). But then is when it got kind of funny. When my fiance then told her she also wanted to close her business account, she was told they did not see one. That was because it was under business and that's where we kept most of our money. That's when something must have been seen, because the supervisor started to backtrack. She was apologizing and trying to keep us from closing the accounts. This was a Saturday, and Monday morning we had someone from BOA call us literally begging us to stay.
We have moved our business account to Wachovia and I am very happy with them. We did keep one account with BOA, but I am very careful with anything I do with them. My advice to anyone who has a BOA account, switch banks if you can. You will see a difference in customer service with another bank (especially Wachovia).

I was called by BofA for an unsecured loan of $50K with no balance transfer fees and a rate of 5.9%. I applied and was turned down. Four months later, I got a bill from BofA for a loan of $52k at a rate of 15.99%. I never approved this loan nor would I ever approve such a loan. I called BofA and they had no answer for me only that I was obligated to pay the loan back at the rate they gave me and to pay the $2,000 in transaction fees they charged. I asked for a signed application approving that rate of which they could not provide to me because it doesn't exist. What do I do? BofA paid down my AX card and then AX in turn lowered my credit limit from $56k to $6k because of the high rate BofA is charging on my unsecured loan I never approved. I did not make the first payment.

At the end of July, I was going to do an electronic funds transfer to another person of $12,500.00 to their Bank of America account. The funds were not available so I was charged for non-sufficient funds on 7/25/08. I talked to a customer service representative on the telephone and told them I understood and wanted to make sure they would not transfer the money again, and I would be charged for another bounced check. They did try to run it again but refunded the money on 7/29/08. This is the last I thought of it until 9/8/08, when Bank of America took $12,500.00 out of another account I had under the same tax ID number because they said they had paid the transfer from July. I could have understood if it was a couple of days but 1.5 months later seems extreme since nothing showed as overdrawn even on statements.
I contacted customer service and asked them at this time who I could report this to. The lady on the phone told me that Bank of America is a private company and does not answer to anyone. There is nothing I could do about them taking the money and they are keeping it.

Just like all the other people who've complained about BoA, I'm also one of their overdraft fee victims. I have been battling BoA since 1-05-09 in regards to this issue and today is 1-09-09. I keep getting the "It's your fault" statement, keep a register, and them explaining how overdraft fees occur. Okay well, I'm an educated person. I know how overdraft fees are incurred and don't need an explanation. I simply asked them numerous times, "Why does my online bank statement only show 6 transactions that have caused my account to become overdrawn and I have 11 overdraft charges?" They cannot answer that one simple question for me. Like everyone else, I have contacted the wonderful helpful people at customer service and they only point fingers, belittle you and tell you oh well, it's not their fault. They don't take the time to answer your question. They automatically assume it's your fault and them charging you is right.
Well, I think they must have a class of how to be rude and condescending to customers because everyone who has answered email, everyone I've talked to on the phone and even the manager at my local branch are rude, unhelpful and just plain ugly! No one via email, phone or in person can answer that one question for me. I have email alerts that say the overdrafts occurred a day after they charged me overdraft charges. They stated my first 5, yeah 5, overdraft fees were due to transactions that occurred on 1-5-09, yet in my email alerts, it specifically states those overdrafts occurred on 1-06-09. On 1-05-09 online statement I have, my account is not overdrawn. So on 1-06-09, I logged on and saw that my account was overdrawn by $142.21. So I immediately went to the bank and deposited $300, which at the end of the day, I received an email alert saying my account balance was low, after depositing $300 and only being overdrawn $142.21. Hence, all five overdraft fees were taken from my account on 1-06-09 for so called overdrafts that occurred on 1-5-09, but didn't show on my online statement.
So on 1-07-09, I checked my balance online and my account is overdrawn now by $41.10. So my husband went to our local bank and talked to the manager who stated that the transactions that caused the five overdraft fees occurred on 1-5-09 regardless of what the online bank statement showed. So my husband fought with him for a while and then he asked him if he went and deposited money into the account right now because it's overdrawn $41.10, would he still be charged overdraft fees? The manager said yes. So it doesn't matter if you deposit money into the account or not, they're still going to charge you overdraft charges. And with regards to customer service telling you to do the email alerts, I never got any email alerts on 1-05-09 showing my account was overdrawn. I got one on 1-06-09 showing the transactions that had gone through and caused my account to be overdrawn. The manager also printed out a transaction history which showed what the online banking statement shows you and what the actual bank sees themselves.
Let me tell you it's two different amounts. The online banking showed we were in the positives and what the bank goes by to charge you overdrafts showed we were in the negatives. How can they go by something different than what they're showing the customer? Is it not our account? Is it not our money? We should be able to see what they see so we can stop those overdraft fees from happening. On 1-06-09, I was charged 5 overdraft fees on 1-07-09. I had three more things pending on my account that once again threw my account into overdraft. On 1-08-09, three more overdraft fees were charged to my account. Today, 1-09-09, I have three more overdraft fees which threw my account even farther into overdraft and two pending transactions (one which is their charge of $8.99 for some privacy assist crap I don't use) which will incur two more overdraft charges of $35. They just haven't put them pending to my account yet. So my account as of today is overdrawn by $317 after depositing $300 three days ago which would have covered all the transactions minus the overdraft fees.
As of today, 1-09-09, they have charged me 11 overdraft fees, credited on overdraft fee which leaves me with 10 overdraft fees that total up to $350 and that's not including the two overdraft fees I'm going to be charged for the two pending transactions. This is a bit ridiculous. There should be somewhere else we can go with these issues. I simply want to know how they can show the customer one balance online but they go by some other balance secretly and charge you overdraft fees. I have a copy of the transaction history the manager printed out and if everyone saw it, they'd be going to lawyers ASAP! I have copies of my online bank statements everyday from 1-02-09 and emails, and the transaction history that came from the bank so maybe someone, somewhere can help me get my money back. I don't mind paying for the items that shows on my online statement, that threw my account into overdraft but I am not paying for some bogus crap they go by unbeknownst to me!

On Saturday (January 3, 2009) I went into the BOA on Ridge/Congress Road and made a cash deposit. I used my ATM card later that day at 2 separate stores - one was a $64.00 transaction and the other was a $2.67 transaction. The next day Sunday 1/4/09 I was texted from my cell phone carrier that my bill was due. I went online and paid that. Monday comes and it shows a minus fee on my bank statement, which I had no problem with. I would pay the overdraft fee figuring that all other transactions were done. On Wednesday 1/7/09 I checked again and it was still showing the same amount that was at a minus on Monday. Thursday 1/8/09 I went and put money in to cover the amount and to put extra in to cover an automatic payment for Friday 1/9/09.
I checked my account when I returned from the bank, only to find that the 2 transactions from Saturday 1/3/09 and 2 overdraft fees in the amount of $35.00 each were posted and there went the money I put in for the automatic payment for Friday. When I called them Friday to decline the automatic payment that was to come out, they told me there was a $30.00 fee. Now I have another $35.00 overdraft along with the automatic payment coming out. I was unaware that a cash deposit on a Saturday would not post till Monday as they told me they do not have to tell all customers that when they make a deposit on Saturday. I asked them, “Do you really think I would use my card for a $2.00 transaction, only to be charged $35.00 if I knew this would happen?” Also that all transactions do not get posted till Monday. So they did not go in the order that the transactions were done and took out the highest of the three transactions first (the last one before the other 2 in order to take 3 overdraft fees instead of just the one).

On 1/08/09, at approximately 8:30 pm, I noticed through my Bank of America online banking account that I was being charged an overdraft fee in the amount of $35 for a personal check, which I issued to be paid on 1/07/09. The check was accepted by Citibank on 1/05/09 and cashed by Bank of America on 1/06/09. I explained the situation to the customer service supervisor named Jamie who failed to provide me with a last name, who states that the bank takes no responsibility for cashing a postdated check and that the responsibility is mine to make sure that the party I issue a check to does not cash such check before the date issued.

I deposited a money order on 1-2-09. I specifically asked the teller if there would be a hold on it - because they put holds on everything. I was told there would be no hold on the deposit. I checked online later that afternoon and the money was in my acct. Needless to say, I wrote a couple checks and used my debit card that weekend. Monday morning when I checked online, they took the money out of my acct on Saturday and put a hold on the deposit. I called the customer service phone # and I was told to go to the office where I made the deposit. I did, and the lady that helped me was very nice (this is the only person that was nice to me). She tried to find out why the money order was put on hold. They would not give her answer why it was credited to my acct. and then taken out.
Fast forward to today (1-8-09), I have had $280.00 in overdraft charges that I feel my acct. should not have been charged. I called the customer service # after they released the money and I was informed that it was not a bank error and they would not credit the charges I incurred. She suggested I go back to the bank to see if they could help me. The lady who helped me in the beginning spoke to her manager and I was told they could only credit back $100.00. I was not happy with that answer, so she went back to her office and then came back and told me they could only credit $210 of the $280 they charged me because I had pending charges after the deposit was made and there wasn't enough $ in my acct. to cover them. Now, if you look online, the $ was there.
Bank of America has terrible customer service. They always find a way to charge you with whatever fees they deem necessary. After all my charges are run through my acct., they will no longer be my bank.

I deposited a $5,900 check into my checking account on 12/18/08; a hold was placed on my account till 12/26/08. I was allowed to overdraw my account accumulating 4 $35 OD charges. I went into the bank on 12/23/08 which is when I learned of the 4 OD fees. The bank manager as a courtesy released $600 in funds and informed me of the 4 charges, stating that there was nothing he could do to reverse the fees. As it turns out, I looked at my account a few days later to learn that there are now a total of 10 OD fees for a total of $350. Where did the other 6 come from? They are not willing to reverse the fees for me or explain where the 10 transactions came from that caused my account to be overdrawn. My bank statements do not show a negative balance, neither online or the paper version.
I am extremely upset at being robbed of $350 from an institution that I trusted with my large deposit only to find out in the end they have no intention of helping me in this matter. I have been told several different things by different BofA employees as far as how to keep track of my account balance. I was told not to use the online banking for a correct balance. I was also told not to use the statements I receive from the ATMs. I was sent a check register by a BofA supervisor and told to use that.

On January 7, I contacted BOA to request a lower interest rate on an unsecured line of credit. This is something I have been trying to negotiate since February 2008. They refused me in the past stating that I have too much credit (the bulk of which is the unsecured loan), and that the only offer they had was an equity line. It almost went through as I had a closing date, but at the last minute I cancelled the closing.
This time, due to further reduced interest rates and my job, I requested that they reconsider. Denise referred me to a Debt Management company that they work with, with telephone number 1-877-357-6309. I told her that I did not want a negative reflection on my credit and that this would show negatively; it’s just the same as filing bankruptcy, and that was why I was trying to negotiate with her. I begged and asked her not to do this as it will be detrimental to my credit score. She said that she was protecting her bank. I asked her how have I been irresponsible with any of my accounts, and she said that it was her opinion upon review of my accounts that she based this on. I had over $2,000 in my checking accounts at that time.
She said that based on my statements about bankruptcy, she closed all my accounts, all four of them, two of which have a 0 balance and one of them with only $1,000 out of a $7,000 credit line. The only high one was my unsecured credit line which I have been paying $500 every month since 2007. This has now eliminated my debt ratio and lowered my credit score to the point I can now no longer apply for a refinance on my home.

I have been noticing small amounts of up to $100 missing from my checking account here and there. What really got me was that I had just balanced my checkbook, viewed my online statement and it matched perfectly with the bank's number. Well that same day, after 5 pm, I went to take out $100 and my account was short $50! I was like, “How could that be?” So, I called their 1-800# and got a representative on the phone. All they could tell me is that it must be the way I am balancing my checkbook. I asked how this could be when I just balanced it and it matched with what they had. They said something about it probably not clearing yet, and I said nope, that is not it. I also told this representative that this is not the first time this has happened. This is not the first time they kept blaming my math abilities.
Needless to say, I hung up the phone and went into a branch office to complain as well. The representative in the bank stated that he could not do anything because I didn't have evidence of what I saw online and what I got from the ATM printout were different (yes, that was my fault, I thought to myself, but why do I need to make print offs?). Well, needless to say, I have been out of $50 - $100 at random times and cannot get my money back. It has not happened since October, but it happens in 4 -6 month increments. So, whoever is doing this or whatever is happening, they know what they are doing because of when the money is being taken out. It’s just enough to not raise any flags, but only with the unsuspecting BOA customers. And then, they’re being made to look like fools when they complain. I am continuing to have $50 - $100 missing from my account in random months. When that money is being dependent upon to make sure my bills are paid, I had to cut things because I don't account for the money to come up missing.

I live in Georgia but get monthly deposits made to my account from California. I have never had a problem until now. My regular transaction was made on 1/5/09 before 2 pm. I checked online and verified this before writing a check. I checked my balance this morning and, to my surprise, I only had $44 in the bank and the check that I wrote had not even cleared. They took $100 out of my savings and charged me a $10 overdraft protection fee. I called to find out how this could be since I waited until the deposit was there to cover this check and now this check was going to bounce.
I was told that since it was an out of state deposit (cash), it had to clear. I asked, "How was I able to see it if it wasn't cleared?" The not so pleasant Rep proceeded to tell me that what I viewed in my account was only temporary and that not only is the money not there yet but it will not be credited back to the date that the deposit was made. So basically, they ripped me off and purposely hold money in order to charge fees. When I told him that BOA had just lost a customer, his reply was, "Can I help you with anything else?" Some customer service, I'm closing my account!

Today a man showed up at my house and said he was the middle man between Wachovia and Repo Company. The letter said we owed $1284 and had a due date of 11/08/08? Odd? Also a lady we have never heard from before, a Brenna ** at 888-254-2886 ext **. We owe a car payment for December currently and Jan is not due until Jan 8th. We made a payment on Dec 5th of $500 and Jan 2nd of $500. We are being treated beyond reasonable tactics here. This company is charging me $1800 for insurance so my $365 car payment is $500 and they claim I have over $500 in late fees?
How can they possibly have me pay $140 over my payment and not cover insurance and late fees each month? This is outrageous! I will be faxing proof of insurance next week to fix that. However, I have had this car since 2005 so why are they breathing down my neck! I want my account looked at as I believe they are mishandling my payments and none of my payments seem to be applied to the principal except for about $100. Out of $500 a month and car payment is $365. Something is wrong here and I need help and don't know where to turn. I truly believe there is something very wrong with this loan and their tactics.
Consequence: Emotional depression and constant exhaustion from the rude and humiliating phone calls from this company and their threats.

I fought in court and won a settlement. Never got any money from the individual. Back to the courts and paid $90.00 more out of pocket to get a garnishment. Sent it to Wachovia. They responded back no account found. I have the account statement in hand so I call the number printed on their own letterhead and get some telemarketing company not affiliated with Wachovia at all. Anyway I call the 1-800-wachovia # and get the royal runaround. 3 calls later, I end up with a fax # and am told that I can fax the paperwork to them with the account # on it and they will re-process it. Well I don't hear anything so a month later, I call my local branch account rep (I am a Wachovia account holder as well). I explain everything to him and he calls them and calls me back, "Mr. **, they have no notes on the account at all so they must not have gotten your info." I ask him for a real phone number after I explain to him about their letterhead having the wrong one. He can only give me 1-800-wachovia!!!
I try that route again. I get some CSR in another dept after 10 min. on hold only to be told that is not her dept but that I should fax the paperwork to them at the same # that I used a month ago. I write my phone # on in 2 uppercase letters. Still no response. I think that I could get the President on the phone easier than Wachovia lien, levies and garnishment dept!!!!!!!!!!! It's been over 3 years since I won this judgement in court and I still am no closer than I was on day #1. Are these people in some underground bunker protected by armed guards or something!!!

We bought a lot in a nice subdivision with intentions of building as soon as our home sold. Then the market took a nose dive and our house did not sell as planned. We were still making our interest only payment on our lot and not missing a payment. The 12th month came with a new bill. FULL PAYOFF due. $201,246.00. I called in and spoke with many people, telling all of them that I was not having a problem making the $1,400/month interest only payment and could I continue doing that until our home sells so we can then get a construction loan. The response was always NO.
I asked to refinance, as both my wife and I have over 800 credit scores. I was again told NO. I even offered a Deed in lieu and to lose the monies I had already invested. No to that option too. I asked several people what option I had and was told, and I quote, "Sir, it sounds like you don't have any options. Just let us take the lot!"
I just recently spoke with Amanda in the law offices handling the foreclosure, and she also said that refinance, extending the loan, or a deed in lieu were not options since the loan was a balloon loan. It sounds to me like Wachovia is looking to run to the government and say "Look at all of these bad loans we have, give us a bailout!" When in reality, they are not giving people any options! I have never in my life missed a payment or been late, and wasn't even having a problem making payments...Now I, too, face foreclosure!! I will lose over $40,000 we invested in this lot and have bad credit, just because Wachovia is a big bully!!!!!! I hate this bank!!!!!!!

I tried to cash my paycheck from BOA and was told that I would have to pay a $6.00 fee or else, they could not give me money. As I cannot afford to pay a fee, I could not get my money that was owed to me. This amounts to nothing less than extortion. I am forwarding a complaint to my State’s BBB/Court and the Attorney General’s Office in hopes something can be done to stop this bank's extortionist policy. Also, I will tell everyone I come in contact with to not do business with BOA. We loan them billions of dollars and in return, they try to put a fee on anything they can think of. They are a sinking ship, and their time is almost up. To their many workers, I say get out now while you can. Also, to anyone that has had complaints, it’s only going to get worse so close your accounts now.

I have a business account with Wachovia. I am a small business owner running a Property Management company and we operate on a tight budget. I am in the process of leaving Wachovia after events that constitute what I feel is criminal fee charging practice on the part of Wachovia. Between holding deposits for random periods of time, processing debits BEFORE deposits on a given day (despite the fact that the deposits were made first), causes multiple overdrafts, and processing largest items first, Wachovia has, through their practices generated thousands of dollars in bogus NSF fees off my accounts.
I've called a bank rep, and a bank officer on these issues on MULTIPLE occasions and have been told that I don't understand Wachovia's FLOAT period... and that they couldn't figure out my account either! They have refunded SOME of the fees, telling me that they're doing me a favor. I would really like to know why a class action lawsuit has not been established to pursue this nationally.
Not only have they cost me several thousand dollars, but they've cost me in time pursuing the issues with their unsympathetic customer service reps, loss of revenue due to delays caused by my account being pushed into the negative by their fees. They have not only ruined my reputation as a solid businessman, they've caused stress beyond belief!
A property management business is basically money in and money out. Previous to dealing with Wachovia, we had TWO checks bounce in 5 years! Wachovia's processing of deposits is definitely a moneymaking scheme, which has LOST accounts for me and has made my customers lose confidence in me!

We have been with Wachovia for quite some time, I have been disabled for the last 8 years and my wife was infected with cancer this last June. She and I have tried to work with Wachovia since and they asked for everything including hardship letters from her doctor and pay stubs, since then. Well they kept harassing us all hours of the night and weekends and I told them that we are working with the loan mitigation dept. and their reply is always, "It doesn't matter it's a separate dept. and we have nothing to do with them."
I called them on December Tuesday the 23rd and I talked to a lady from Wachovia named Kathreen who said she would keep in touch with us to let us know if a program has been worked out. Well, she never called even after telling her we were making a payment on December 26th. We made that payment which only put us only two payments behind. They took another payment out of our checking account on December 30, and now we are totally broke.
I went to the branch and the lady there contacted the home office and told them the story but not before being transferred 5 times to different people and finally getting to the right one. They finally confessed that it was their fault, but they would have to do a wire transfer which could take up to four or five days. I told my helper they took it out fast enough they could put it back or cut me a check there in the bank. "Oh no, we can't do that," said Lupe ** of the home office. Then he tells me this, out of the blue, "we can give 400.00 of the 952.00 back and then your new payment plan will be 1372.43 a month starting Jan 1, 2009 or give you the full 952.00 and we will drop the program with you, by the way you can't do anyway, and we will never work out another plan again with you!"
To me that's a threat! And not working with people as they say they do, look at all the complaints online they have. Now we are totally broke, no money, for at least 5 days and they expect us to take this lying down! Where in the world, are the people that are working with us common people. They can just walk all over us and fly off in their jets laughing.

I made a deposit that unknowingly had a large check that was not signed. BOA allowed the deposit and credited my account. My balance reflected that deposit accurately. One week later, I received a note dated the same day I made the deposit with the check stating it was rejected for deposit because it wasn't signed. I immediately stopped using my card or checks even though my balance was still reflecting the check went through. I had the check signed the same day I was informed and re-deposited it. BOA put a hold on the check. All during this time, which was over Christmas week, my balance always showed credit for the check and I was able to access my account; however, for about 10 transactions, I was charged $35 per item over limit fee. My wife called, and they reduced a few of them. Then, the day the check hold was supposed to come off, it didn't. They charged us another seven $35 fees. When I called, they were not apologetic at all. The representative, Letitia, said it was my fault for writing checks or signing cards when I knew it wasn't good!
I used the card because they never told me the deposit didn't go through, and the usage was over the weekend when I had no idea. My balance was still well in the black. When I asked why they didn't call me right away, she said they don't call customers for security reasons. They send notices in the mail and by email if they are on online banking (I am). When I said I have an online account, but didn't receive any alerts, she said I must not have enabled alerts. I told her that I would be closing my account, and she made no effort to apologize or to save my business. It appears BOA is now in the business of increasing profits $35 at a time. These posts indicate a willful and calculated system of extracting $35 fees out of people.

I spoke with a cs rep about opening a line of credit with BofA. I was never told or I did not hear it that they would be charging me a fee to loan me the money. After they were going to get my interest they then charge me almost $600 in fees to get the loan. They are a horrible bank that should be forced to disclose all of this information or at least give the customer the chance to back out of the loan after receiving the PACKET that is received AFTER they charge you these fees.

I have been with Bank of America for about 7 years. This holiday, I went shopping for Christmas but before I went I checked my balance to ensure I had the funds. On DEC 26, They charged me 4 overdraft fees. When I asked them why, they stated that I had some transactions that had not showed up until the 26 that was made weeks ago. I asked them why it took so long and the supervisor decide to belittle me and tell me I should of keep better track of my funds and that it's not her job to add it up for me.

I've had a free checking account for at least 10 years w/ BOA. Use it mainly to pay BOA credit card bill online so keep under $100 in it until just before I pay the card. Usually deposit a bit over the amount owed, pay the card, check the balance, do it again next month. I've never had a fee assessed until this month. Looked at my online statement and a $20 fee appeared. It was tacked on 12/22/08.
Finally got a live agent on the internet (they don't have phone service on the weekend). She said my account was switched to Advantage checking on 12/22/08. I didn't switch it, nor did I receive notice about this. The only authority the agent has is to remove the charge and switch the account back like it has always been. She said she doesn't know why or who did this. As others have said on this forum, BOA must be having some hard times. This is shady and illegal. Whatever happened to NOTICE? Watch your accounts people.
Since I caught this fast and the $20 was returned, only time was lost. However, because I maintain a very low balance on purpose, this recurring and unexpected charge could have triggered overdraft fees of which I would not have been aware. I can certainly see how people who do not bank online and wait for monthly statements could be tricked into overages by BOA. People may say, well, bank online, then. That isn't an option for the poor, most elderly, and many others who are just not computer savvy... millions of people.

I have been a victim of Bank of America, despite being a loyal and faithful customer of theirs for over 5 years. I have seven, yes seven account with this company. Between checking, savings, CD's, business accounts and lines of credit. I send ALL of my clients to them when assisting them with their banking. Well, not anymore. As an avid user of my BofA Debit Card, I had made several small purchases one week (as I always do), between the days of Tuesday - Sunday, Dec 16-21st. For some reason they did not post until the following Monday the 22nd - despite having been paid days prior. There was one large $366 car payment due on the 22nd which unfortunately would cause an overdraft of $35 to my account. However, BofA decided that the $366 charge would not be the one to overdraw my account but instead every single one of the other tiny little $5, $10 and $15 purchases that I had made the week prior would get hit with the fee - RESULTING IN FIVE $35 CHARGES!!!! The very next day I deposited money into the account, assuming the $35 had been deducted for the $366 charge.
Well it wasn't enough. Because when they charged me the $175 in fees, it caused my account to overdraft AGAIN - resulting in two more fees. In total, I was charged $245 in overdraft fees. HOW CAN THEY DO THIS TO PEOPLE???? How can a company get away with this? I spoke to a representative on the phone that was condescending, rude, impatient and patronizing. I left in tears, hopeless, as he told me to give up because anyone else I spoke to was going to say the same thing he did - that they wouldn't correct the charges and that it was my fault. He advised that I read my banking paperwork to realize that the mistake was entirely mine. How can I have so many accounts with an institution, consistently refer them business and still not be able to speak to anyone who can offer me some assistance or COMPASSION? I am outraged and wish to cancel all my involvement with this organization. Do not do business with a company that does not respect or help their clients.

I was charged about $455 in overdraft fees or more in less than one week and received the most deplorable customer service leaving me feeling worse than degraded and literally in tears. The bank is familiar with my family as we have been customers for over a decade. The bank employee I customarily deal with is aware that my husband is diagnosed with terminal brain cancer, and I have asked her to assist me so that we do not incur unnecessary fees. We have always had a good relationship with B of A (especially when our balances were four times the amount they are at present, hmm....is that just a coincidence?) and had and still have adequate savings to cover any overdrafts, etc. But somewhere along the line, B of A changed one of our savings to a checking, and the fees were slammed on us.
Our account balances have been dropping quickly and steadily since he's been out of work, and with incurring high medical bills (surgery, chemo, radiation, etc) along with my recent job loss, we can least afford any unnecessary expenses or bank charges at a time like this. Because our accounts have been steadily draining, I needed to make some account changes. I visited the branch several times last month to discuss my concerns about my accounts, but the wait time to see a bank rep was always longer than I was able to wait (a minimum of 45 mins or more) and was always encouraged to return to talk when it was less busy for them. Unfortunately, before I was able to ever get the help I needed, I was called out of town a family emergency. The fees incurred while I was called away caring for my seriously ill and elderly mother.
As soon as I was back, I went to the branch to ask for help but I was turned away and told to call customer service. Customer service on the phone told me they could not help and to go to the branch. I spent hours on the phone with service representatives, one who did a lousy job of holding back his laughter and was sarcastic and giddy with me while I explained the hardship and dilemma I was facing. My experience under the circumstances with this bank employee was traumatizing. It's ludicrous (not to mention cruel) that the bank will not forgive these fees that would never have occurred had they had the time and professional courtesy to service my accounts when I required the attention to avoid these fees.
I made three trips to see a customer representative, but they were always too busy to help me. Now, especially at a time like this, two days before Christmas, dealing with a terminally ill husband and seriously ill elderly mother, the least of what I can afford is the undue stress. What adds insult to this injury is that I maintain a small business account with B of A as well. A sizable unauthorized withdrawal (presumably bank error) occurred on this account recently, and it took days to correct it, causing me a great deal of stress and inconvenience. I just can't believe the arrogance and insensitivity of bank employees who are allowed (or perhaps encouraged?) to fail to serve their customers properly, causing them additional stress and financial hardship under these circumstances. Had I not been an understanding and patient customer, back before I was called out of town, I would not have incurred these fees. Now that I'm asking for the same from them, this bank is turning its back on me. OUCH!!! Merry Christmas, Bank of America.

On Dec. 3, I opened a checking acct. depositing $25 into it, on Dec. 4th I deposited 431.51 into my b of a acct. I also wrote a check for my rent which was $649, knowing that it would not be deposited until I got paid on Dec. 5th. So when I got paid on Dec. 5th, I deposited my check for $814 & some change. I tried to use my card later that day and it was declined. I called Bank of America and they said the were closing my account due to risk prevention. So I was ok with that, what I wasn't ok with was that its now 12/23 and I still haven't receive my funds, and they rejected my rent check and I have other bills that are now past due b/c they are holding $1200 and its x'mas time. I called and called and called and they just do not care about people's life or obligations. I am sooo furious and disappointed with this stupid bank! I NEED and want MY money...

I recently opened an account w/ Bank of America. I don't like to hold cash, so I'm the type of person to use my debit card ALL the time, if not, I would go directly to the bank and make a deposit or withdrawal. In any case, I just found out my account is closed. I was NEVER notified. Now, with Christmas being 2 days away, they closed my account and I am unable to get ANY Of my money whatsoever out of my account. The Bank of America reps will not tell me why the account closed, and will not let me touch ANY of money. This is the worst banking experience EVER. I have no money for food or Christmas because they will not let me touch ANY OF my money.

Don't know if it's my bad luck or what but I have been having problems with my B of A accounts. Too many problems to list but the most recent was.... Started on 12/9 to 12/10. I had made a transfer to several accounts from one account. It showed the transfer was made so I logged off my online banking. Next day in the morning, I checked my account and that money was back into the original account so I thought that was weird. Didn't question it. I made the transfer again, made sure it transferred. Okay, I logged off again.
Next day in morning, I checked my account again. I was hit with 2 overdraft fees and now my account was negative. The original amount from the 1st transfer. I was so mad and I didn't call because I knew nothing would have been done, so I sucked it up.... but it has been bothering me. So today, 12/22/08, I decided to called B of A. They said there was no error from their part. So they did not refund the fees. Of course because I had no proof they didn't do nothing. That's why I'm posting this as last attempt to see if anyone out there is having the same problem.
So today, I'm going to start printing my transaction history at least 3 times a day EVERYDAY (am, afternoon and night), keep record on paper so when this happens again, I will let them have it and possibly file charges. I will have to waste paper and ink but I will catch them once and for all!!!! I have had nothing but problems with them these past months and I'm getting really tired. P.S. I have another similar situation that happened to me about 1 1/2 months ago. I'M SICK OF IT!!!!!!!!!

I too had my interest rate on my BofA credit card jacked in Jan of this year... from (roughly) 7% to 23%. I had never been late on any account, credit score in the low 700. They could not give me a reason and could not confirm (on 5 different calls) that if I 'opted out' that my interest rate would in fact stay at the 7%; not trusting them either way, I did not send the opt out form. Jump to Oct. I get my statement and where I had $5K available credit I now have less than $500... Good thing I hadn't charged anything. I had not received any notice of a limit reduction.
I called and they said, "It's in the mail". I received it 2 weeks later. It was at this time I canceled the card figuring at least they could play any more games with me. I was wrong. Today I received my statement and I have 2 balances... a 5% promotional which didn't change and the purchase which has now dropped to.. .21%. Having closed the card, I thought it was odd that the 21% balance had gone up. I started pulling statements and with NO Purchases... the balance was rising about $300/month. I called and after about 25 mins, I was told that my monthly payment (averaging here) of $500 goes to the lowest interest rate first (I knew that).
My avg monthly interest amount is $300. Of that... $5.00 is for the 5% balance, the rest is the 21% balance. When they take my payment, The total amount of the $500 goes to the 5% account which is the $5 of interest and the rest to the balance. NONE goes to the interest that is being charged on the 21% account. So when you see your statement of $300 in interest, every other card I have pays the interest with in and the difference goes to the balance. Not with BofA. They are taking the 'outstanding' interest on the 21% balance and applying that to the base amount owed. This has averaged about $300/month for the last several months of statements I pulled. That means they are increasing my balance via interest which they then charge interest on that that new balance.
THEY ARE CHARGING INTEREST ON INTEREST!!! I will point out that they will not call it 'interest' (though the rep I spoke with finally admitted it was interest). They called it 'Finance Charges' and 'yes' they do charge finance charges on finance charges; perhaps the loophole... semantics. I will not stop accruing finance charges that I will accrue finance charges on until the 5% balance is paid off which is luckily soon... but until then... that will give them another $600 plus interest on that. While I accept fault for not noticing this earlier, it obviously would not have made a difference in their practices. I can't believe this is legal.

They keep calling and calling me and I've asked them to stop. I also get calls from another phone of theirs in which the person was extremely rude to me - it is 480-389-3910. I've asked them to remove me from their calling list and they hang on and will not hang up.

Bank of America must be hard up. They are driving customers away with their hidden fees. They must know they are going under and are getting as much as they can now. Just hit with $160.77 plus $39.00 in overdraft fees. When I paid the balance by the statement due date to avoid further finance charges, there was another finance charge of $75.05. I was told this was still accruing in between the statement due date. I was told it will take 2 billing cycles to get the final balance of your account paid off. Customer service was very rude and said we have no intention of removing the $75.05 charge that I had been unaware of.

After working with B of A for months, due to a medical problem, I was told on Friday by Kieth that I was a dirt bag, and did not pay my bills for a year. And if I wanted to talk business lets talk business!! I told him I would like to speak to a supervisor and I was recording the conversation. He proceeded to tell me that he was a supervisor then he became a specialist. After he literally rapped my background and cursed at me numerous times, I had enough. This call started at 2:45 on Friday, Dec 12th and did not end for at least 1 hour. His co-worker Sue ** , told me two and a half weeks ago that I would have to come up with 2500 dollars. Now they want 6000 dollars and attorney fees.
I am so glad I recorded this conversation because I will not rest until they pay for what they put me and my family through.. You think the people on wall street are crooks.. Bank of America should be put out of business for the way they treat customers... I am sending a copy of the tape to the banking dept and the attorney general's office and the money that I was going to give B of A I am going to use to bring that little ** Kieth and his superiors to court!!!!

I filed a dispute 60 days after the services on my car went south. Bank of America never gave me back my money because they claim to have lost my dispute documentation. I have proven time and time again that I filed within the 60 days and they keep saying prove it again. I finally sent a letter to Edward Hawthorne asking for resolution. Dawn ** called me today and asked me to scan all 45 documents I have and send them to her. I told her that would take me a long time and she said, "Why don't you get the influential people you know to help you?" In my letter I had said that I work for influential people and am not keeping it a secret that Bank of America won't give me back my money. I told her that they have ruined their good reputation in my eyes and I wanted to speak with a person with good customer service skills because I am about to take them to court. She put me on hold and of course no one else called me back.
Then I called the Office of the Chairman and they were not only not apologetic but told me once this case has been delegated to someone (who clearly doesn't have my best interest in mind) that there will be no one else to speak to. I am taking them to court because they have no regulatory agency I can report them to and usually a judge will side with a small person if they have proof. Sorry for all of you who have to be treated in a criminal manner by this bank. I hope they get what they deserve.

For the last 4 to 5 months my checking account keeps being overdrawn mainly because of overdraft charges. Back in September after putting over $8,000.00 in the bank from a life insurance policy of my sister who died in August, they put a hold on the account and then started charging NSF charges and sending back checks with that money in the bank. $35.00 a pop. Later they took the hold off, but I was charged quite a bit in NSF. We live on Social Security Disability and with prices going up and having to pay NSF charges, we don't have enough to live on each month. Even if you are just a penny over then they charge you $35.00 and it just keeps rolling on. I have put money in the bank when it says pending, but the next thing I know, it doesn't make any difference. I have a NSF charge.

I made a deposit on 12/9/08 for 255.00. On 12/10/08 in the am my husband tried to use the card for about 5.00. It was declined. I called the bank and told them the situation and they told me no fee would be charged for the rejected transaction. Yet a fee was charged. This also happened with another deposit a few weeks ago. They rejected some items, did not pay them and then charged me for them!!!!

Bank of America is notorious for charging exuberant fees for one transaction. My son ordered me a Xmas gift on November 24th & as of December 10th after I stopped doing business with them, my account is still getting fees??? And they charge you every freaking day without your knowledge. If your money is not available & there is an overdraft, I was told they were doing me a favor by allowing me to get my items. Yet they charged me $35 eight (8) times & when I confronted them, customer service was of no help. THEY ARE RUDE BEYOND BELIEF!!!!! I have never, ever, ever spoken to ANYBODY AT BANK OF AMERICA THAT WAS HELPFUL. I will now do my banking at Chase Manhattan. Screw Bank of America & their overdraft fees!!!!!

According to the information online on my son's checking account, he was $1.36 overdrawn, but his account was hit with three overdraft charges at $35 each. Then for the next three days, his account was hit with two more overdraft fees (each day). When we contacted BOA customer service, we were told it was because of charges pending... though they weren't showing up as pending at the time. Of course because of the $280 in NSF fees, he became overdrawn again. When we were finally able to speak with Steve, the supervisor, he read everything just like the bank told him to do AND repeatedly said when 'we' do this and when 'we' do that - in an extremely condescending manner.
When you are already frustrated, the last thing you want to hear is we highly suggest using a register... Oh my gosh, are you kidding me, because they are raping the consumer. Now they are directing us back to a manual paper register - when they encourage the use of online banking by offering perks. Needless to say, I am tired of Bank of America's tactics and unfortunately we are helpless. I'm looking for a good Federal Credit Union, so we will be treated with respect like a good, long-time, customer should be instead of being talked down to, like we don't have a brain cell working and that we are out to screw the almighty Bank of America. After all, there is NO WAY they could possibly know what our intent was...or so Steve said... look at an over 10-year history and get a clue!

I cannot stand Bank of America - these people get bail out money from the federal government but will charge you overdraft fees up the wazoo for purchases less than $2.00. What makes me even more upset is the fact that you can go to an ATM or use online billing to look up your account balance which will report you have a certain amount in you account but the next day when you check your account, you have a negative balance because some check card purchase you made a week ago which once existed in your pending transactions was not posted that same day. Well if a payment is not posted in my mind that is still pending, but BOA will take the pending purchase off the account and process it whenever they feel like it without including the transaction in the balance. So now they would like to charge me for overdraft fees on the amount of 1.99. I closed my account today and refuse to pay those fees. They can go somewhere with that, they make too much money to ripoff customers for less than 2 dollars. Their online billing sucks and they should be investigated for unfair reporting of balances.

Something fishy is happening at Bank of America. Today, the bank placed a ten day hold on a routine deposit I made to our small business account. The check in question was drawn on a government account -- an official state check -- and could easily be verified in about ten seconds, not ten days! This is not a new account, it is more than a year old, and I have had other accounts at the bank for nearly 30 years, with no returned checks or deposits ever! Is Bank of America running out of cash? Looking at the other complaints on this site it appears that they might have changed their policies recently to take every nickel they can get their hands on and hold onto it for as long as possible.
They are legally allowed to hold the deposit, I know, but I have never seen them insist they will do so for the maximum legal time period involved. My advice: given what is happening consumers should ask BofA how long they need your money before they will give it to you BEFORE you make any deposits! I think they should have disclosed the hold before they accepted the deposit and not doing so appears to me to be a form of theft (us giving BofA a loan of our money without our permission). Watch out for BofA -- something very fishy is happening there this week.

In 2007, I closed a checking account I had with Bank of America, that was overdraft about $500 ($300 in overdraft fees!) because of unauthorized transactions that kept posting on my account. BOA told me that since my card wasn't stolen, that they could not do anything about the transactions- or the overdraft fees. So, I just closed the account. They did allow me to open a new checking and savings account (I later switched the savings to another checking) and I've had it for awhile now. Besides the overdraft fees that come all too easily, I've had no problems.
Suddenly, there is a $32.48 debit from my account that is pending, and it just says 'debit/hold' so I contact the bank and they say they have to wait for it to clear. When it clears it says it's from a 'forced closed account' and Bank of America says they are authorized anytime your account has a positive balance to take out the money owed! Not only that, I had about 10 pending transactions from over the weekend, and some PayPal transactions (which don't show up on my account for about 3-5 days) so my account went into negative. I tried to take money from my other checking and put it in and for a day it seemed fine. Then, after the business day was over, I was charged with two overdraft fees.
Now, I've been on the phone with about five different departments at Bank of America saying I need the transaction code provided back in 2007 in order to fix or even make a payment arrangement for the closed account- and I have to eat the $70 overdraft fee caused by the $32.48 that came without any warning. Every department tells me I need a new department on the phone, and I'm pretty much getting the run-around.

On 11/16/08 I took advantage of an offered sent to me via email to open a new checking account online with a $25 minimum deposit and BOA will match the $25 dollar deposit. The application included a co-applicant.
On 11/18/08 I received and email indicating my application was being processed. A couple hours later, I received an email indicating the application had been denied. I immediately contacted the number on the email to find out what the problem was. After speaking to the customer service rep, she indicated that something was missing off of the application that someone could have easily contacted me and verified. I spent a half hour going over information with her on the phone about me. She resubmitted the application. On a few hours later, I received another email indicating the application had been approved and I should received my account documents and information in the mail within 3 to 10 business days.
On 11/22/08 (Saturday), I received all of the banking info, a pin number for the account, the check card, signature cards to return etc. I spoke with a representative online chat because I was confused about the PIN info they provided and also because my name was not complete on the card. She told me I would have to contact customer service during banking hours, which meant the upcoming Monday.
On 11/24/08 (Monday), I contacted customer service to inform them of the name correction, also to inquire about the co-applicant bank card and I was told to contact the risk department because the account was being closed. I called the risk department and asked the rep what the problem was because I had been sent all of the documentation including the bank cards and his response was BOA has the right to close an account without any given reason or notice just the same way a customer can close an account and not inform them as to why. I clearly indicated to him if there is a problem, how can I fix the problem if I do not know what it is. Was it Chex Systems or something else.
So unsatisfied with his rude response I drove to a local branch. A personal banker then called the same number I was given and they told him the same thing. Again unsatisfied, I went home and tried several times to get an answer, by now it was after normal banking hours. So I then went back and contacted the application department. I spent about 40 minutes on the phone with a representative who was actually really nice and took the time to investigate the problem. He informed me that myself, but mainly the co-applicant had to go in and show proof of identity and residence because they may been a victim of identity theft. I was informed this information was on some kind of system that only BOA uses called the Merlin System which basically is a legalized hacking system. Of course, once this information was retrieved it was now after banking hours and I would have to wait until the next day.
The following day, myself and the co applicant went back to the branch and gave them the information that was provided to us. The personal banker once again contacted the risk department and gave them the whole story and the risk department told him that it was too late to submit any information because we missed the deadline which was the day before.
If you notice, I did not indicate that I had to complete any of this by a deadline because I did know there was a deadline, which was the same day the account was closed. And I would not have known about the closure if I had not called to inquire about the check card and the completion of my name. I was then informed that since I missed the deadline I could NEVER open an account with BOA again. However, the rep that provided me with the information and told me what I needed to do, told me that I could reapply and open and account with just myself and once my co applicant can correct their information, just add them to the account.
It isn't that I need the account because I do have another one, it is the principal. BOA did not want to help, I have spoken to several rude people and just the same today. After contacting the application and risk department today to inquire about the deadline I knew nothing about again I spoke to a rude women in risk named Pam who told me that when I went into the branch they obviously weren't willing to stop the closure because the branch manager can override a closure and since they didn't do that when I went in on the 24th to get answers, I can never open an account with BOA once I have had one closed regardless if the reason for closure had nothing to do me.
These rudeness of customer service is beyond anything I have ever dealt with. Pam clearly informed me that they can close an account at any given time and they DO NOT notify the customer of closure. I presented a scenario that if someone balanced their checkbook and wrote checks to pay bills or whatever knowing they had available funds but BOA closed the account without notification and therefore all the checks would bounce. She said it is not their problem, that you should check your account beforehand, that is why they have the automated system and customer service. But in the event that did happen they would not honor the checks and charge fees on top of it.

I had an account with BofA that was used for my condo's HOA where several signers were on the account. One of the owners of the HOA released his interests in the building and therefore we had to have his name removed from the bank account. This person also had a business bank account at BofA that somehow was linked to the account used by the HOA. We were told by several people that in order to have a name removed from the account, we either 1)had to close the account or 2)we could have all the other signers write and sign a letter asking BofA to remove this person's name from the account. We went with option 2 and hand delivered it to someone at the local branch. I had not yet put my name on the account and when I did that with one of the other owners, we asked the bank rep if the name of the previous owner had been removed and she replied that he had so we did not think any further action would be taken.
Shortly after adding my name to the account money started getting transferred to an unknown account. It turns out that BofA had never removed the previous owners name from the account even though we attempted to get the name removed and received verbal confirmation that it was, so they started transferring money to his account to cover overdraft charges he was incurring. BofA now refuses to reverse the transfers and the HOA is now out $600.00 which is a lot of money to a small HOA. I have spoken to at least 3 different reps, and a supervisor and they were all unwilling to help.

I was charged 3 overdraft fees for $ 35.00 each for transactions processed on Nov 28th. According to when I used my debit card, there were only 2 transactions that took place on the 28th, of which only one would have overdrawn my account. When I called the bank to find out why I was charged 3 fees, I was told that the bank charges fees based on how much is in your account the day you use your card AND the day that the bank processes the transaction. So, according to the bank, it didn't matter that I had enough money in my account to cover all transactions that I used my card for, by close of business on the 27th. The fact is that by the time the transactions were posted I needed to account for all of those, as well as what took place on the 28th.
What upsets me about this is in the past, I have been charged fees and if you look at the date that the bank finally processed/posted the transaction, I had enough funds to cover, however, when I questioned the bank I was told that I'm sorry the bank doesn't look at when the transaction gets posted but instead looks at the date you actually used the card. In those instances I have been charged a fee. Now today, I had enough enough money in my account to cover based on when I actually used my card. But now the bank is changing their story to say that that doesn't matter. They look at when the transaction gets posted AS WELL AS the actual day the card was used. I got very frustrated with the rep who started to make an analogy using apples. Saying that if you promise your neighbor 5 apples.... I had to cut her off and ask her not to use that type analogy with me and that I was an accountant and understood numbers. The rep then went on to say "ok if you are an accountant then simple math is...."
She ended up being rude and unprofessional. I asked her full name. She told me Angela ** from the Southeast region. I asked if she had some employee ID# and she said no, that was her identification. I then asked to speak to a manager and she told me that she would put me through to her manager's voice mail. I said I don't want to go to anyone's voice mail and that I would speak to any manager that was available. I was told there was no available manager that I could speak with. I did end up leaving a message for someone who I couldn't make out their name due to a heavy accent.So, I was left out in the cold with as far as I'm concerned, unsatisfactory customer service and I can't truly identify who I spoke with. So again, THE BANKS WIN!!!!

Bank of America's change of heart - which is not to say that they have one - is hurting my credit! On Friday, Nov. 28, I opened a checking account with Bank of America. (I already have a checking account at Washington Mutual - exceptional customer service, by the way! - but was getting ready to travel in an area of the country where WaMu branches and ATMs aren't nearby. ) My total balance the day I opened the account was roughly $375. Over the weekend, I made a few cash withdrawals, used my debit card several times and also arranged an online payment. On Monday, I tried to check my balance online, but my user ID, which had worked just fine the previous day, wouldn't work. I called the customer service line and spoke to a representative who said she couldn't help me and gave me another number to call. When I called that number, I was told that Bank of America had determined that I was "a risk" and was therefore closing the account.
Since I'm not on Chex Systems and had passed their credit check, they opened the account, but later determined I was too risky. (I've opened accounts at similar national banking institutions in the past few months without any problems, but BoA apparently has different criteria.) I explained to the associate that I had outstanding transactions and also needed money from the account for little luxuries like gas and groceries. He just kept repeating that the bank had decided to "terminate the relationship" and would send me my funds via check in 10 to 15 business days/two to three weeks.
In the interim, I wouldn't be able to access the funds because the bank had decided to freeze the account. Sure enough, when I tried to withdraw some gas money from an ATM, a message on the screen informed me that my card was invalid. On Tuesday, Dec. 2, I spoke with a manager who had introduced herself to me when I opened the account and asked me to let her know if she could ever be of any assistance. Well, I definitely needed some assistance. After reviewing my account, she said that the bank would pay the debit card transactions but would reject the online payment of $25. When I asked why they were rejecting the payment even though the funds were there, she said that the funds actually weren't there because the bank had frozen the account.
Huh?! I said again that the funds were available - and then some - and she said again that the bank couldn't approve a transaction of that amount. (Is the economy so bad that $25 is considered a risky transaction - even though the funds are there?) I explained that if the transaction didn't clear, it would be reported on my credit report as a late payment, negatively affect my FICO score and remain on my credit report for seven years - through no fault of my own but because the bank arbitrarily decided to close my account, without even notifying me. She apologized and said there was absolutely nothing she could do to override the system. When I pointed out that the bank hadn't even been courteous enough to inform me of the reversal of their earlier decision, she said I'd be receiving a letter in the next couple of days.
I've heard numerous complaints about Bank of America through the years, and now I understand why they are always mentioned at the top of poor customer service surveys. Had I known they would treat me this way, I obviously would never have applied in the first place. I'd much rather pay some extra ATM fees than deal with a bank that's sold its soul at the expense of its (would-be) customers!

On Nov 6, 2008, I signed up online for the Keep the Change Program offered by Bank of America. On Nov. 7th at 4pm, my checking account was closed. I only knew about this because at 5pm I was trying to use my debit card at the local store. It was declined so I promptly called the bank to find out why. Once I called, I was told there was a hold put on my account because of some fraudulent activity. I asked for the hold to be taken off, and I was told I needed to call the security office, which had put the hold on the account (at 4pm on Friday) which happened to also be closed for the evening, and was told they did not reopen until Monday.
After many of complaints I finally got a hold of someone on Saturday who stated my account was being closed because there was no telephone number listed on my account. I was never asked for one. I was then told the remaining funds would be sent to me via certified check and there was nothing else I could do. I could not reopen the account, or pick up my money at the bank, only wait for this certified check. So now I sit with no funds whatsoever and get fees for every check that is not returned to me.
After about 10 days I had not received any check, and my direct deposit had cleared into the account on Nov 15. I again called the bank to find out why they accepted money into a closed account. I was then told they were waiting to close the account fully and they will take deposits, but no other transactions. I finally was able to get off of my military base and visit an office in person. I had come to find out I was even charged overdraft fees by Bank of America. I have finally gotten my account reopened and have withdrawn almost all of my money at this point, however have still suffered huge financial problems because of the closure and them holding my funds and refusing to let me withdraw any of them from my account.

My boyfriend signs his weekly check to me and we had been depositing them in the ATM during our Friday lunch hour to save time as Bank of America claims their new check scan will allow funds to be accessible immediately. Until of course, they freeze the money 3 days after deposit and don’t clear such for 10 days!!!
After depositing two checks in the amount of 1004 one Friday before we were to spend 3 days at a friend’s wedding a hold was placed. Both online and ATM accounts listed the funds to be cleared on Saturday so we went on our ways using the funds that weekend. On Monday when we returned a hold was placed on the checks due to the name on the account and signed over check in a different name. Fair enough, we went down to the bank to clear up the situation. Apparently, someone in Arizona (we live in Massachusetts) placed a hold and did not return any of the branch manager calls as to what form to sent to clear the issue. We were left for 2 weeks with no money due to a bank error! Then when I called to refute the numerous overdraft fees that were inquired over the weekend the bank had the nerve to say it wasn't a bank error but mine as I used fund on an unclear check that they deemed uncleared after they listed it as clear!!
Then 2 weeks later a check my cousin wrote to me was returned due to insufficient funds. However, again it was listed as clear and then 4 days later as on hold. Bank of America didn’t withdrew that amount 2 times!!!! A bad check from someone else was taken out 2 times from me (totalled in 600 dollars!!) When I called them back to redeem this situation they said I would have to wait 2-4 days for a letter in the mail to confirm the refund of this money and any over draft fees cause by it. Yet again, I am left for 2-4 day with no money to eat or pay my pending bills!
It should be illegal for a bank to take money that does not belong to them and have the ability to hold it for however long they deem fit.

For a $2.00 mistake, overdraft. Because of this overdraft, I was charged $210.00 in overdraft fees at $35.00 x 6. I have online banking and monitor my three accounts, the overdraft in question was taken care of the same day it happened. But they continued to take fees after I kept putting money in by transfer. I want 5 of the six refunded to me. This was Christmas money I needed.

Bank Of America is robbing my daughter-in-law with their overdraft fees! We were told that a check deposited in the ATM would allow a transaction to go through. It didn't and she now has 7 or so overdraft fees @ $35 a pop for small purchases ($4, etc) because of the initial overdraft. The service center was rude. They refused to help her out saying it was her fault because the check was deposited at 5:05 and missed the deadline. I specifically asked the person on the phone if the check would be counted that night. He did not tell me to check the time when items would be collected. I would have had time to go to the next little town where the branch is opened until 6 if I was given the correct info.
Bank of America refuses to take any responsibility for this situation. They are punishing my daughter-in-law for being working poor! My daughter-in-law will be charged close to $300 and will just have to let the account go to collections. Bank of America is robbing my granddaughter of food by stealing her mother's money! This bank needs to be stopped. I've been a Bank Of America customer for 10 years and will be closing my account as soon as I can. Bank of America needs to find out that it can't make it without the little guys!

On Tuesday, November 25, I noticed my checking account was negative by $0.60. I talked to a representative on bank of america's website and was advised to go to the bank and make a cash deposit before 3 pm that day to make sure no overdraft fees would occur. I drove 45 minutes to the closest location to make an $18 deposit. It was 8:30 am exactly. I know because this made me late to work and the drive-up had just opened. The woman at the drive-up said I wouldn't receive an overdraft fee. Later that day I checked my balance, and I was out of the hole. Wednesday morning my direct deposit from work went in and I was quite a bit of money. I checked my bank account again at 5 pm that same day. I HAD AN OVERDRAFT FEE! I was fuming.
I got on their website and talked to one of the representatives who gave me a courtesy refund. WHICH DIDN'T POST UNTIL SATURDAY NOVEMBER 29! I checked my account Saturday morning I was negative! How could this be?? I checked, they charged me two extra overdraft fees! When they charged my the initial overdraft fee, it sent me into the negative. I had two pending transactions of between $2 and $4 dollars which had not posted. Since the $35 was not returned until Wednesday AFTER those two transactions had cleared I went into the negative. Again fuming, I contacted Bank of America, someone (I'm sure not from AMERICA) told me there was nothing they could do, asked to speak to a supervisor who was extremely rude. She told me there was nothing she could do and it was my fault not the bank. Well not in my opinion. I contacted a local branch and spoke with a manager. She said she had no idea why I was charged the two overdrafts and that her computer would only allow one refund. She gave me the refund, leaving me $28 in the hole. I managed to get to the bank today and deposit the money. Bank of America is a rip off.

Overdraft fees of their ways of doing business which is illegal. I personally am out, for the past year, over $1000. Of bogus OD fees. Just like all others that have posted here, please let all of us know what and where we need to contact. They must be stopped. Where is the/Our legal system???? Where do we go to get our $$$ back that this banking system has "stolen" from us. If this continues, and the legal system does nothing to stop it, do we all have to show up on the Capital's steps. Please bring back the morals and values that the forefathers of our country, wrote and signed! The constitution of the United States of America.

These investment specialist have succeeded in losing over half of my husband's retirement account. Then they sent us a form saying we needed to move to self-directed investing when we had so little left that it was not feasible for them to continue to manage our account. We now have not enough left to retire on or really do anything else with. Loss of over 150,000.

I noticed 2 $35 fees, total $70 drawn from my account. Upon calling them, they stated I removed my overdraft protection and that was the charge. In fact, they argued with me that I had to call and remove it. It was illegal for them to do it without my permission. I did not remove it, makes no sense whatsoever, they are screwing people and taking their saving to cover bad debts from other customers. Just look at their credit card INTEREST! I closed my savings, will pay off the card and they can kiss my ass. Now I did tell them they could do that!

Fees being assessed to my account that are not accurate. I started with a balance of $259.70 on 10/24/08. I made a cash deposit in the amount of $300 at 10 a.m. There were 4 debits that posted on 10/24/08 totaling $179.00. These posted transactions were activity from 4-5 days prior to the posting date of 10/24. On 10/25/08 I withdrew $120.00 from the banking center drive up teller. My statement is reflecting this order of transactions.....

This is $140.00 in fees that were assessed to my account for transactions that were not accurately accounted. If I put CASH in my account and it is in before the same day posting cutoff time, and a day later take out $120.00 they cannot be flipped around just so the bank can charge me $140.00 in fees. They have resorted to stealing from their customers. It eventually now has spiraled into 10 fees totaling $350.00.

On October 4th I paid $35,000 towards my line of credit which had a balance of $53,000. The banks says that on November 17th my payment amount was to be $884, which was the minimum based on the prior balance. I had sent them $500 on November 3rd in expectation that the minimum would have been reduced. However, I was contacted on November 25 and told that my minimum was not reduced and that I was late on the difference. Additionally, that my credit line was now frozen and that it would remain that way until the balance was paid. Furthermore, that the minimum would not reflect the new balance.
I find it hard to believe that I could in good faith pay such a large amount towards my balance only to have them freeze the account and then state that the minimum would not change. This is not the agreement I had signed which states the minimum is based on the balance. My main frustration came when the gentleman said "we are the bank, we can do what we want!!!!!"

This is the 3rd issues I have with BoA. July 4th weekend they claimed their teller entered the wrong number and they tried to withdraw $3000.00 from my account which flagged my account and froze it for the weekend so I cancelled all plans because I didn't have access to cash. I tried to open another account with my wife because I just got married and the credit union I wanted to open the account with said they couldn't do it because I was put in the Chex Systems and it was from BoA and I was still banking with BoA.
So, I have to wait for BoA to investigate to see what happened before I can't even open an account anywhere else. Also, from what I was told the name from BoA that claims I owe them money isn't even me but it has my account number on it. 3rd incident happened on the 17th of November. A payment went through for an American Express card of which I don't have an American Express. I called and they said they can't do anything about it but they have to investigate this also before I can get my money back.

Initially had an agreement that when my employees cashed their check, they would not have a $6.00 check cashing charge. Bank of America has recently changed that agreement and now have implemented the fee. In my opinion, Staff Relief money is in this bank and we are asking them to transfer the money to the party that it was issued so now fees should be charged. I have been with this Bank of America since 1991. This is causing a hardship on some of the employees as they are Certified Nursing assistant and live from week to week. Bank of America broke their agreement with Staff Relief Inc. I would like to know if anyone has a class action lawsuit against Bank of America. I realize that the lawsuit in California regarding check cashing fees had been won but the attorney in CA used an 1911 California law which I don't think Georgia has.

Rude customer service and steal the maximum. I had a E-ZPass commute and I have set it up to deduct from my checking account. It got deducted all of a sudden and wasn't being displayed as pending transaction the whole day. Next day I saw it got deducted and whatever small transactions... they charged overdraft fees ($35 three times). I had deposited the money on the next day. Problem here is Bank of America takes the overdraft fees first and the transaction I make the next day. I get overdrafted again ($35 twice). I know this was my miscalculation. I end up losing about $180 in total.
Couple of issues - BOFA says it is not obligated to show all transactions as pending on online bank statements...so it's hard for me to track what's pending that day and they were rude to say it's your responsibility to track and not ours. Also a transaction I made a week back, it falls on the day when the account is less and there is no way to know if BofA is doing it on purpose to make overdraft fees. Overall they are mean enough to take any amount of hard-earned dollars from the customer in the name of overdraft and nothing can be done. I seriously hope some day they would be in the receiving end and get bankrupt.

Bank of America debited my balance of $1,100.00 from my checking account without prior notification. When I called BoA customer service, they told me that my Wife Business Credit card was in default and they took the money out of my Joint checking account. I do not think it is legal to withdraw money from a joint account to by a business card to a sole person. Even the IRS has a form Injured Spouse? Which protects the innocent party and does not allow a collector to collect a debt from an individual to a joint account. How can it be possible for bank of America to debit my JOINT checking account to pay of a debt on a business credit card to an individual?

I recently applied for a loan from a Bank of America from a mail solicitation. I have an excellent credit score and applied for the loan, calling the toll free number on the application. Someone from BOA recorded the information including my home, cell, and work numbers as well as my Social Security number, address, etc. I applied for the loan on November 2, 2008 and heard nothing from BOA in the ensuing weeks. I received a credit alert from Experian on November 17th that a new account had been opened in my name, and when I checked my credit report, I found Bank of America had opened a loan in my name. To make matters worse, the credit line was for $500 and not the $20,000 I had applied for.
I contacted Bank of America to complain and was transferred to a credit analyst who informed me I didn't qualify for the amount I had requested, so they decided to open a loan account for me in the amount of $500. I informed them that I did not want the $500 loan, nor did I ever give them permission to open the account without contacting me first. They replied they had tried to contact me and I never responded. Bank of America is lying: I never received a call from their credit department about the loan application. I feel this is a predatory lending practice by Bank of America to entice consumers into opening new loans under false pretences.

I had an open line of Credit linked to my Checking account. I always kept it at a zero open balance by the end of the month. BOA decided to close my account. WHICH IS FINE. During this period before me finding out they closed it, Several transactions bounced. Which if the line were open would not have. This resulted in $245 in bank fees from 10/27 to 10/31. When I called them back, I wanted nothing more than from them but to refund me the $245 in fees I had been charged for my account being overdrawn instead of the credit line processing that. I was TOLD, "YOU WERE SENT A LETTER, NOT OUR FAULT YOU DIDN'T GET IT." After getting that same response from several supervisors, I gave up.

Bank of America can get bailout money, but I guess it's not enough to use tax payers dollars to float your business and claim in front of Congress that your doing the right thing with the borrowed money. So you blindside credit card holders with outrageous rate increases for any reason they see fit. We, the consumers, who do everything we can to stay in good standing. Have had the rug pulled out from under us. We were forced to used Credit cards to buy gas and food and maybe we cant make more than the min. payment, but we pay on time and what we get in return is being ripped off and beaten further into the ground. These Credit Card companies should not be allowed to take advantage of people like this. We need help.

We received the check $13,000 to replace it but had to send it back to BofA endorsed by us so that they could endorse it and send it back. Well, that's been weeks ago. They said they would release the check when the inspector inspected the roof - weeks ago. We found out yesterday that they haven't even set up a time for the inspector and the roof has been done for weeks! Our roofer is waiting for his money. The fact that this check has to go back and forth is just ridiculous! This roofer should be getting interest on not being paid the money that he is due.

I set up "auto-pay" with the Bank of America so that I would NEVER be late with a payment. I set it up that way because I have been hearing all sorts of horror stories about credit card companies just waiting for you to be late and hiking your interest payments to an amount you are just unable to afford. Well, much to my surprise, after I set up my "auto-pay" via Bank of America, they created a pay date that is 5 days overdue! When you set up the auto pay, you can only check, yes, sign me up for auto pay with a payment amount of $**. You are not able to select the date you want it to deduct. I have attached a copy for your review.
Additionally, one would assume (now I know never assume) that it would default and/or be the due date! Never in my imagination would I think that a company would default to a date that would make you late! I am completely unable to change the date. Customers do not have access to that feature. Well, as you can guess, they have decided that I'm late and then my interest should now be 28.99%. My rate prior to the auto-pay was 10.99%. I called them today and spoke with over 9 people, and have been on the telephone in excess of (4) four hours!!! Instead of accepting responsibility for the error, they just keep offering me unsecured loans at ridiculous rates! I did nothing wrong! When I try to obtain people's names, I am given fictitious names.
When I asked why they would not provide me with last names they stated that they did not want to give real names! The names I did receive were as follows: 1st - Would not give any name; 2, Will - no last name, 3. Nathan **; 4. Daine ** (will not give last name); 6. Sarah, - no last name; 7. Jeffrey, online services who agreed that this is a problem but could not help me; 8. Heidi ** (no last name). Also, the last person I spoke with would not give me a last name. In exhaustion I stated; 9. Kirisa will not give last name; and finally 10 Dorothy "prefer not to give last name." I'm curious as to why I have had to give all of my personal information to 10 people, i.e., name, mother's maiden name, social security number, account number, income, etc. to 10 people who will not give me a last name???
Although the online department stated that this is a problem, they stated that they were unable to help me rectify the situation. The online number is 1-866-797-8479. Therefore, at this point I am unable to change my interest rate. I am a single Mom and have always paid on time. I have been a Bank of America customer for I think min. 17 years! In all honesty, I feel that this is a pure and simple "SCAM". Customers are so afraid of being late they will just allow the company to take the money out of their checking account monthly due to the recent problems with the economy. Customers would never in a million years suspect that the company would allow the auto-pay to be late! Please, if not just for me, please help the people that always pay on time not be extorted by these companies. I have never been late until I set up the auto-pay.

I have had a checking account for over a year and have recently been receiving numerous overdraft fees. The bank will clear bigger items first so that they can charge you more in overdraft fees. Also, they are charging overdraft fees on pending transactions and money that is available in my account. I have had so many issues with them in the past two months alone. In one instance, I made an ATM deposit and a month later they debited it back out of my account saying that they couldn't find the deposit. That's funny because the deposit was made in cash and the ATM is high tech that it counts the amount for you!!! I am so tired of this bank.

This past week my son accidentally overdrew his account (I am on the a/c with him) in the amount of $14.10. This was caused by three small purchases using his debit card. His account was charged three overdraft charges of $35.00 each for a total of $105.00 in charges. I felt that the charges were excessive and called the branch hoping to get at least some of them refunded. Karen was clearly not interested in anything I had to say and was quite rude through most of our conversation. I told her my son was just out of college and not yet working and she replied that maybe he wasn't responsible enough to have a debit card!
This Campus Edge account (including debit card) was suggested to us by the branch manager over four years earlier when my son was leaving for college. During the same conversation, I asked Karen if we could request that purchases be declined if there was not enough money in the account and she said no. So apparently Bank of America wants you to overdraw your account so they can charge you these huge fees. I just don't believe that a system that can post your debit on your account immediately can't decline it if you don't have enough money in your account. I also tried to get help through their online help services. The response was, "We're sorry for any inconvenience this may have caused you."
Since I feel that Bank of America can no longer serve me in the manner I want to be served my family and I have decided that after over 15 years we will be closing all of our accounts by the end of this year. That includes a number of checking accounts, and IRA and investment accounts. My extended family plans to do the same. We believe there must be other banks out there that are a little more interested in their customers.

This bank allowed someone to steal over $73,000.00 from my VA direct deposit account. They were abled to change my security question and answer, close and open multiple accounts, ATM withdrawals of $999.00 several times in a day and then daily. I demanded the return of the money but only have received $8,800.00 so far and they said they will not give me any more money. I have been evicted, lost everything. I am a 62 year old Vietnam Era Veteran getting 70% service connected PTSD compensation per month. I have not slept yet for days. In so much pain. I have an attorney working for me, but they are giving him and the OCC a hard time. I even have my US Senators office working on this but Bank of America CashPay refuses to budge. HELP!

I deposited my (government) paycheck in my checking account 10-31, the same paycheck I have had for the last 5 years biweekly. They put a hold on it until 11-4. They returned all my creditor checks I mailed and charged me $35.00 per (7). My branch (that have known me for 15 + years) could only return 1/2 of the fees. It is very strange that Bank of America designates weekends and holidays as due dates on credit cards but they don't return the favor of using the same as hold days on checks.

Bank of America put stop credit on my account by my request. They did this because they said I had a $500.00 charge that I did not have copies of. Finally I got the statement an unauthorized individual in my company used the card. I was disputing the charge until I could verify what the charges were. Finally they faxed the bill to me and paid BA in full. However BA wanted me to pay late charges. I refused since I could not access my account online due to the stop on the account. They could not seem to fax me a copy of the statement. BA agrees that I contacted them, not the other way around and that I stayed.
Now Encore a collection agency is texting me on my company cell phone attempting to collect on late fees. I am incurring text message fees and long distance charges on my cell phone at work. I have repeatedly asked this company to stop calling me as the late fees are not valid and I will not pay. I have received $47.60 in fees on my cell phone in November from Encore. In October I receive $89.00 in charges for long distance. In November to date I have $47.00 in long distance and text messaging so far.

Bank of America decided to close out both my checking and my savings accounts that were both in good standing a few days prior to my SSDI direct deposits for me and my kids. They refuse to give me any information on when my money will be returned to me or on what grounds they are holding my money from me. It's not much money but it's all me and my children have to survive on for the month.

Over the last two years, I have seen Bank of America charge a friend of mine over $3,000.00 in returned check charges. He is mentally disabled and has his SS check deposited in a savings account. He has been allowed to open a checking account despite the fact that I have told him that he can not handle a checking account. Therefore, he writes checks when he does not have the money in his account and they charge him $35.00, two times for every check he writes. They have taken his whole check for bad check fees for the months of August, September and October. Just these three months total over $2200.00 in check charges. I have spoken to them until I am blue in the face about his illness. He has no money for the necessities of life like food and shelter as Bank of America is getting their pound of flesh for allowing him to have a checking account even though they have been apprised of the situation and it has happened on more than one occasion.
Last year I had to give him over $1200.00 to keep them from sending him to Chex Systems. They are non-caring, insolent and rude. I have changed to the Suncoast Federal Credit Union because I have experienced this first hand with my friend. We need a class action lawsuit. Who agrees? This bank needs to be exposed for their practices. This man is bipolar - he has extreme highs and lows. He is not responsible when it comes to handling a checking account. This has been explained to them but they do not care. They keep leaving the account open. In my opinion, they do it to collect the fees.

I am a student from South Africa and did some holiday work in Boston during December 2007 and January 2008. During January 2008, I opened an account with the Roslindale Branch of Bank of America. I was issued with a Check Card but not an ATM PIN. I told the consultant that I will leave some money in the account on my return to South Africa. I was told that I can request a wire transfer to my South African Bank Account at any time.
For the last three weeks, I am trying to initiate a wire transfer, but the service from Mary is absolutely terrible. At first she said I must send her an original certified letter requesting the wire transfer. She confirmed receiving my letter via courier but then told me that her boss does not want to approve the transfer. I made contact with the Wire Transfers Department of Bank of America who told me to request a specific form from Mary, to complete the form and send it back to Mary. She must then send the form through to the relevant department who will process it and I will then be able to get a Telephonic PIN to initiate a Wire Transfer.
I requested the form from Mary last week Tuesday and gave her my Fax as well as E-Mail. Needless to say I have not received anything and when my father called the Branch an hour ago and was told by Ian that they will send the form immediately. Still nothing! What am I supposed to do. I did everything that was required from me, but Mary just ignore me! Can somebody please help! I am taking up a position as a teacher in London beginning of 2009 and need the money urgently for air tickets/visa etc.

Bank of America designates Saturdays, Sundays and holidays (when postal and banking services are not available) as due dates on credit card accounts in an effort to unfairly generate fees and interest. I feel this to be an unfair practice used to manipulate accounts to generate late fee charges and additional interest. Normally, I pay my balance in full each month and on time. With a Sunday due date, my payment was not received until Monday. Result: a late fee and a full month’s interest plus additional interest for the following month.

I deposited a rather large sum of money into my checking account. It was in the form of a check, from a rather large and prestigious company. The check was held for 10 days. I was told that this was to allow the funds to clear. This was money that I was using to pay bills. Because checks and automatic debits were scheduled, I was charged seven (7) NSF charges at $35.00 each.

I live paycheck to paycheck. I use bill pay thru BofA. I went online to check my account, got the balance minus what they had pending and made sure i had enough to cover everything with a few dollars left over. Well a bill pay came thru that I thought was paid out so instead of everything clearing the way it was when I checked online they put thru larger payments first then charged me overdraft 2x instead of 1x. Now keep in mind all items CLEARED on the same date. This is how its always been with them. Now I do admit my account hits overdraft more often than I would care to admit but every time BofA clears these items and charges me way more overdraft fees that should be because of the way they clear items out of your accounts. To me it's not fair but for now I cannot afford to change banks. What do you do? And when you use bill pay and have your items set up for certain days, they change those dates to make payments come out earlier even if the money is not there and charge you overdraft fees. I have have paid so much in overdraft fees I couldn't even begin to add up.

I have been receiving Social Security Benefits since 1988. I opened an account online with Bank of America for the purpose of having my benefits directly deposited to the account as well as paychecks from my part time job. On October 3rd, 2008 my Social Security check was to be deposited into my Bank of America account just like always. I had no reason to think that it was not going to be deposited, so I started to make purchases with my Bank of America Check Card and by writing a few checks. When I went online on Monday October 6th, 2008 to pay my electric bill, I saw that I was more than $50.00 overdrawn.
I looked and my Social Security Benefits had not been deposited into the account as they always have been before. Social Security when called advised that they mailed me a letter on OCTOBER 3RD, 2008 advising me that my benefits had been ceased, even though there is an appeal pending. (I received the letter on October 10th, 2008.) My checks from work were not to be posted until that Friday the 10th and I could not stop the direct deposits. Upon calling Bank of America and advising them of the problem and requesting that the account be closed, was told no, they wouldn't close the account.
Every check and debit card transaction was presented over and over and over and over each time resulting in a $35.00 fee. Bank of America has taken over $800.00 in fees out of my account since October 3rd, 2008. When calling their customer service line was advised by four different representatives that they would not refund any of the fees. Now I have lost everything I had in pawn because I was unable to pay the interest to renew the loans.
My power, water and phone have been shut off (I'm on a library computer.) My house is in foreclosure, have no food and am going to be homeless in winter in Montana. I was on Social Security Benefits due to a childhood brain injury and am not able to advocate for myself.. There will be no recovery for me and have no choice but suicide.

On Saturday, November 1st, my son purchased a new tool at a store for $154.04. The salesperson inadvertently debited his card for $254.04 which he voided immediately and debited the correct amount. Bank of America took the $254.04 AND the $154.04 amount out of his account which caused his account to be overdrawn. They then charged him 2 $35 NSF fees. Even though the $254.04 debit transaction was voided immediately on 11/1 by the store, it took Bank of America until 11/6 to put the $254.04 back in to his account. There is no trail on his online banking though, they just cancelled the transaction which now shows his account as never being overdrawn but the $70 in fees are still taken out of his account. I called Bank of America in Chatham on Thursday to speak to the manager about getting the fees reversed but the teller told me he was out of the branch for the day. I went there today to speak to him in person but he was with a customer. I left my number but he never called me back. I went online to the customer service and chatted live with Moss from India who was able to reverse the fees for me. Tomorrow my son will be closing his Bank of America account!

On a $7.00 overdraft, my daughter was charged over $200. in fees in just a few days without notice. The transaction causing the overdraft was pending according to the bank and that's why it wasn't posted on her online banking. So, since she does her banking online, she had no idea there was a problem until the fees accrued exponentially. She went to the branch and was told nothing could be done about it. Being a college student, this is her first bank account. I feel she has been taken advantage of and abused as well as ripped off by this bank practice. Have there been other complaints about the B of A fee practices and how they take advantage of innocent teenagers?

Customer Service through Bank of America should be renamed Customer Disservice. The Bank offers absolutely no flexibility with people who live paycheck to paycheck. I was never in the habit of racking up overdraft bank fees until I started regularly using Bank of America. Most banks will allow you to transfer or deposit funds to cover any overage and not assess a fee if the transfer is made same day. Not the case with Bank of America. If your account dips under even for one second and you don't catch it, BAM! $35.00 late fee. For people that live paycheck to paycheck, this is NOT the bank for you!
I was drawn in by the supposed ease of online banking but there are no ATMs or physical bank branches in my area. I cannot even deposit money through another bank's ATM (Bank of America doesn't allow it). In order to transfer funds from another account online, there is a TWO-day window. Which means even if I WERE to catch an overdraft before it happens, there is no way I could actually get the funds into the account without driving over 100 miles to the closest branch. Some banks offer real customer service. Use one of those. DON'T use Bank of America.

I had an Equity Loan with Wachovia in 2006 and I got sick and was hospitalized for over a month - during this process my home was foreclosed on the mortgage loan was with GMAC with the 2nd mortgage with Wachovia. When the home went into foreclosure while I was hospitalized when I was only 2 months being on my mortgage and it was sold on the courthouse steps however, the buyer did not pay off the 2nd mortgage even though there was over 23,000 equity in the house and the balance owed was only 106,000 and the 2nd mortgage was only 8,000 - the realtor that purchased the house did not pay the second mortgage. I am now being sent notices from Wachovia's collection agencies regarding payment of the 8000.00 which should have been assumed by the purchaser of the foreclosed home.
The same week the house foreclosed I was still in the hospital so my son went to Dalton to meet with the real estate agent that bought the house to make arrangement to get my furniture out of the house. He secured a moving company to pack and move my furniture to storage and when the moving company arrived, packed the furniture after receiving the invoice, we discovered the real estate agent had moved all the furniture out before the moving company arrived and only left a dining room table and 4 chairs and a china cabinet along with clothes and misc. items.
We had prepaid the moving company 2700.00 to move 3 bedrooms, living room, computer room and breakfast room and kitchen which the realtor had already moved out within 5 days of buying the foreclosed property. The neighbors took picture of the realtor, his wife and father-in-law moving the furniture out prior to the moving company arriving. I moved to North Carolina after getting out of the Hospital and constantly being sent letters from collection agencies regarding the 2nd mortgage. I informed Wachovia of the situation with the 2nd mortgage but they continue to call and harass me. Do I have any recourse regarding this matter? I am a widow on a fixed income and cannot afford to pay 8000 for a loan that should have been attached to the foreclosed property.

I am a college student that had gone to Wendy's drive-thru one night for a meal no more than $10 and charged it to my Bank of America Debit card. This transaction was made at 12 midnight during the beginning of the month of June on 183rd Street in Skylake Plaza, North Miami Beach, Florida, which is a city over from mine. The following day, approximately around 9am I received a text message from Bank of America stating that my balance was lower than it was supposed to be, so I checked my online banking. Apparently someone used my card at a gas station for the amount of $67 at 2am at the Skylake Plaza gas station.
I had cancelled my ATM card and received a new one. During this time I had plans to go to New Jersey for the month of July, and when I had asked to have any other information forwarded to my mother's address in New Jersey, they stated that there was no way they would be able to forward any mail to my temporary address. During this time, I had already contacted the manager of Wendy's but she did not take any action whatsoever.
When I was on the phone with B of A claims, the woman did tell me that I could file a police report, but B of A would more than likely file their own report and credit back the money into my account. I had/was reimburse right away, and had received my new B of A card before leaving to New Jersey, but did not receive the affidavit form that the bank had wanted me to fill out. During the following month, while in New Jersey, I noticed that B of A had taken the money back from me. I had called and asked them why, they said that the reason was because they had not received my affidavit form, and after the report had been received I would be once again reimbursed.
Once I returned, I had filled out the form and faxed it to them the following day, telling me that they would give me a call back from the claims department within 10 days after the form was reviewed. I did not receive any confirmation and two, three weeks passed and I still not had heard back from them. Once again, I contact the claims department and they e-mailed me the copy of affidavit, and I faxed it, this time receiving a confirmation number. Another three weeks pass by and no response from Bank of America. By this time it was September and B of A reports that the status of the claim still had not been processed and tell me to wait another 10 days.
Once again, another two to three weeks pass by and I call B of A. It was the beginning of October and I had spoken to Diego. I ask Diego what is the status of my claim and he reports to me that my claim had been denied. By this time I was furious and ask him when was this decision made and why had I not been called or informed about this. He said the claim had been denied the 3rd of October 2008, and the reason why was because they did not find any fraudulent charges. I ask to speak to his manager, and he transfers me to Shannon. Shannon reports the same thing that Diego did, and I ask them why I had not been contacted and criticize Bank of America for their poor customer service. I ask to speak to someone above her, and she transfers me to her supervisor, Mackenzie. Once again, I get no answers and never received my money back.
Also, whenever I spoke to the three of these B of A representatives, they gave me different responses, and stated that I even had a "history" with the gas station that the purchase was made. When I asked Shannon the "history" there was only one previous transaction made beforehand, and when I asked Mackenzie, she would not give me a number, but stated a numeral amount. Also I disputed the fact that I am not a big spender at all, and if you looked at my transactions, you will see that even at a gas station or anywhere else did I ever spend no more than $50. In fact, my 2007 2-door Pontiac G5 wouldn't be able to intake more than $50 even during the gas prices at its highest. Also, they stated that since it was a debit card, there would be minimal chances that it was fraud, which I found ridiculous because here in Florida, all you need when you pump your gas is a zip code, and there are a choice of three within my area, where it would not be difficult for anyone within this region to use my card without a pin. When I asked Mackenzie if she would be able to confirm if they used a pin number or a zip code she stated she would not be able to confirm that (?).

Contrary to everyone on this board I am very happy with Bank of America. I've been banking with them for the past 30 years and I've had one single problem and it was taken care of immediately. The managers are active and aware of problems with customers and I have no complaint. Most of these problems that people have are overdraft fees. I don't mean to be disrespectful but maybe if you kept a thorough record of your transactions and balanced your checkbooks, this wouldn't be a problem.

It is a common tale. There was about $80.00 in my account. Five transactions posted in a single day totaling around $275.00. They post the largest transaction first, one for $200.00. This put me over the limit, so the four additional posts totaling no more than what was currently in my account all now cost an additional $35.00. I understand that for the day I had insufficient funds. That now costs me $175.00, rather than a mere $35.00 if they had processed them in an order different than highest amount to smallest amount.

I cashed a check at B of A and paid the six dollar fee, but they can't give me a receipt. How in the world does that make sense. She gave me pamphlet explaining why I have to pay six bucks. I said when I pay for something, I should get a receipt, even when you buy a 25 cent bag of chips you get a receipt. They did not comply.

I called Bank of America (B of A) on 10/13/08 around lunch time Eastern about consolidating some debt and asked what they had to offer me. I had planned to go through a few credit card companies and then decide on my best offer. The B of A associate I spoke with found an open account, that I was not aware of, and that it had enough available credit line to do a balance transfer so I could pay off all my other debt and I would only have one account to worry about. This was exactly what I was looking to for. After going through all the steps and discussions on interest rates and transaction fees payment schedules it was settled.
To me I didn't need to go any further. The opened account had a 0% rate for 1 year, and the guy I spoke to was Darrell ** and he said he would waive the transaction fee if I wanted to do the transaction right then and not continue my search for another company. It sounded perfect so we proceeded to go through the bank routing and the final steps and finished the transaction. I never asked that the fee be waived; I was told the fee would be waived because I was considered a good customer. I would have continued to look elsewhere and if no better offer was found then I would have called back and took B of A's offer. The offer of no transaction fee sounded very attractive and I took the offer.
When I received the first statement on the account the transaction fee was on the statement. When I called B of A about the fee being waived, the associate said they could not waive it or never would. I asked to speak to a manager and obliged and connected me to Leslie **. Leslie was confrontational, degrading and rude. She spoke down to me, asking me, "Does it sound right to you, Mr. **, that a bank would just give you money without collecting a fee?" I said, "It does when your associates tell you that is how it is going happen." She spoke over me and did not listen to me or my complaint. When I finally asked her to let the customer speak, she kept quiet but I felt like she was doing something else and still not listening to me due to the pauses and excuse mes when I asked questions. She said that she would not waive the fee and if there was anything else she could do. I asked to speak to someone else and she said there is no one else. At this point she said if there wasn't anything else she could help me with she had things to do.
To me this is committing fraud when associates tell consumers one thing to get business, the company does something different against your will, and does not even attempt to correct the problem. I was told at least a dozen times that the fee would be waived and now I am stuck with it. I want to give the money back but I am still tagged with this $1200 fee. It is a scam by B of A and I hope there is something someone can do about this before to many people get burned by this fraudulent business practice. If not this is very easy money for B of A. Has this happened to anyone else? Please help the little people fight the giants since it is our tax money helping bail these giants out of their own mess.

Someone wrote me a check off their Wachovia account. The amount was $45.00. I cashed it at SunTrust, which is my bank. The next week, SunTrust sent me a copy of this check saying Wachovia sent it back to them because they could not locate acct. SunTrust told me that Wachovia stamped over the account # on check and did not bother to try and pull it up using the name on the check. I was then charged a $10.00 fee because of this. SunTrust has since refunded my $10.00.
I went to Wachovia twice and they will not verify that it was their fault. When I ask why they couldn't have just pulled up account by the name on check and they replied they only use account #. Wachovia told me I just need to contact the party on the check and have them write me another one. They just did not want to admit their mistake and try to help. As a matter of fact, the young lady told me if it made ME feel better she would say it was their fault in a sarcastic manner. I found them to be very unprofessional and the party that wrote me the check will be moving their account to a bank that is more customer friendly Thank-you.

On Sat Nov 1st 2008, we went to Wachovia bank as my son who is 24 had some payroll checks to cash. The payroll checks are from my business checking account as my son works for me. There were four checks in all. We arrived when the bank opened and my son went in to cash the checks. About 25 mins later he came out after waiting that long at the tellers window while she counted and recounted the checks for the $900.00. My son came out to the car and informed me that I forgot to sign one of the four checks and would I sign it and come back into the bank with him as he did not want the teller to think he just walked out the door and signed the check himself. So I grabbed my drivers license and went back into the bank with him. The teller he had was busy so we were prompted to the next teller.
I was annoyed by then as this was already over half an hour to cash these checks. So we got to the teller and my son told her he wanted to cash the check and she asked him if he had an account and so forth. I handed her my license and said to her "Can we please just get this done. This has taken long enough already." So she looks at me and says "Ma'am you don't have to talk to me like that." So I said to her "Talk to you like what? Just cash the check and let's be done." I was getting more annoyed so I left the bank to go back out to my car and wait for my son. He comes out and says to me "The teller wanted to know your name as she wants to report you!" So I said to my son "Report me for what?" She said to my son after I left the bank if I was his mom and what my name was.
My son said to her "Please just finish cashing the check and give me the money." She said to my son "THAT'S OK. I WILL LOOK UP HER NAME MYSELF. I HAVE ACCESS TO ALL HER INFO." We'll when my son came out and told me she wanted my name and she was going to report me, I went back in the bank this time with my husband and took my license in again to give her my name and see why or for what reason she wanted to report me? She was busy so I went to the customer service rep counter and explained to the rep what had happened and handed her my license. The rep was very nice and told me she would have a bank office call me on Monday. Meanwhile the teller (who turns out to be the Teller manager Bobbie **) comes over to the customer rep counter and I said to her "I came back in the bank as my son said you wanted my name and were going to report me?" So I said to her "for what" and "here is my name."
She said she did not like my attitude and asked my name and I said "and your is?" She laughed and said "I am the manager and my name is Bobbie ** and do you need me to spell it or wait a minute and I will get my card for you." As she is walking away from the customer service stand to get her card SHE YELLED BACK TO THE CUSTOMER SERVICE REP "CALL 911, I WANT THIS WOMAN REMOVED FROM THE BANK." I was shocked and appalled. I am 49 years old and never treated that way. Never have even gotten a traffic ticket in my life and here I stand a customer in the bank and yelled at by not only an employee but a manager. There was a bank full of customers, employees and I was stunned, shaken and embarrassed to say the least. The rep that she told to call 911 would not even do it. She just stood there in amazement herself.
When we left the bank I said to my husband that maybe we should stop at the police station and report the incident in case she does call the police. We did stop and speak with and office - Corporal Brian ** and he told me that he would write a report but that I she called the bank on Monday and speak with him. He also told me he has been there all day and he never got a call from the Bank. I feel this manager abused her rights many times from first telling my son (who is not a child, he's 24) that she would look up my name if he would not tell her, then yelling in a bank full of people to call 911 and have me removed. I am very upset about this...

I opened my checking account online. I had just moved to Texas and am staying with a relative until I find a place of my own. Wachovia closed the account on October 15, 2008 without notifying me because they claim they were unable to verify the address I gave them. On October 20, 2008, I deposited my last paycheck from my previous job. At this time, no one told me the account was closed. The teller who performed the transaction was unaware that the account was closed. At the time of my deposit I was told I would have to wait until October 29, 2008 to draw on the funds. That was acceptable. During the next nine days, no one from Wachovia bothered to contact me in any way to tell me the account was closed.
On October 29, 2008, I attempted to pay a bill with my account, since I had not been informed it was closed. NO ONE FROM WACHOVIA HAD BOTHERED TO CONTACT ME!!!! The electronic check was returned, account closed. I contacted the local Wachovia branch and finally learned the account was closed. After an hour on the phone, I spoke with loss management and learned what documents they wanted to verify my address. I had to actively seek out the answers insteads of them doing their job! Now, I am waiting still two days later to get my last paycheck credited to my account. Wachovia has been collecting interest on my money for twelve days and it is just too hard for them to do their jobs and credit it to my account. It should have been done immediately, not put in line with other transactions. NO ONE AT WACHOVIA WILL TAKE THE RESPONSIBILITY FOR WHAT IS THEIR MISTAKE!! The loss management department did not do their job and contact me.

My checking account seemed to be in the red all the time, no matter how much or how little I spent. I discovered that the bank was being dishonest, and not updating my account information online, or through the ATM or automated phone line. As it turns out, debits are not immediately withdrawn from your account, as such, the bank doesn't feel obligated to update your account information, until the money has actually been paid to the company. Therefore, your account may say $50, but since you just spent $30 at a restaurant, you really only have $20. Then, when I would overdraft, I would be charged a $35 fee.
I repeatedly called and questioned the practice, and requested again and again detailed account statements. I started to notice that not only was this happening, but the bank would often wait to assess the overdraft fees until they reached a point in which the fees I owed were higher than my account balance, which would again put my account into the red. There would be no warning or message that my account was overdrawn, despite having signed up for text notifications of my account status. I would think I had money in my account, buy a $2 cup of coffee, and be assessed a $35 fee.
In one trip to a coffee shop, I bought a coffee, and then decided to get a doughnut, because these were two separate transactions, I was assessed a $70 penalty, for a coffee and a doughnut. I was eventually directed by customer service to speak to a representative in person, so I chose the Milton branch, because I happened to be driving by. I stopped in, and was informed that due to my frequent overdraft charges, which at this point equaled a few thousand dollars, I was not eligible for overdraft protection in the classic sense. He could set me up with a line of credit, and as he stated, this would prevent the $35 fee, but the charges would be subject to a substantial interest charge 19%, because of my history.
After doing some math, this would still save me a lot of money, and the credit account was fee free he said. A few weeks later, I received a credit card in the mail, which I wasn't expecting. I continued to use my debit card, and was shocked when I got my first bill. Not only was I being charged for the amount of money I withdrew, I was still being assessed the overdraft fee of $35 and now I was paying interest on this fee. I called customer service many, many times, only to be put on hold, or yelled at. The representatives all told me the same thing, it is my responsibility to keep track of my funds, and it's my fault I didn't understand the contract I signed. I have never received any explanation as to why they lied, even from the man who originally sold me on the line of credit, and to this day, I am stuck with a Bank of America account, because they won't let me close it unless I pay off all the fees, which I refuse to do.

I noticed a number of discrepancies documented on my B of A account in a recent credit check, so I wrote a letter to Bank of America. I informed them that I had entered into an agreement with Bank of America on or about November 2001, whereby a monthly payment would be sent automatically from a Debt Consolidation program and no further activity would take place on the account. Accordingly, no fees would accrue either. While there may have been a delay in the first payment being sent, the account shows a consistent history of past due payments beginning in April 2002 and continuing for several years. I requested that they please investigate your records on this matter.
I received a response from Kristy ** that, "We will no longer respond to the issues listed in your most recent letter (?)". I was flabbergasted and wrote back, certified this time, "I am very concerned with a recent letter from Kristy ** on October 23, 2008, stating that B of A was required to accurately report the status of all accounts, but would not consider investigating your own inaccurate reporting." Has anyone had any luck in a similar experience? Interestingly enough they will not even include an address on any correspondence. I had to call and get an address for the Customer Satisfaction Department...

How is it legal for a Wachovia to exact NSF fees for transaction that should have been covered by your account balance as in this example: Balance $200.00. 5 Transactions hit account on the same day, $50, $50, $50, $50, $1. WACHOVIA takes that as: Balance was $200, Withdrawals posted = $201. Number of transactions = 5 = 5 NSF FEES!
This is how it was just explained to me by the bank manager at one of their locations while I fought to have their online statement explained to me as to why I incurred so many overdraft fees! According to my account history from Wachovia.com, they withdrew $70 from my account the day BEFORE 2 charges posted. With the $70 IN the account, it would not have BEEN overdrawn. They shrug it off, saying their website isn't accurate. Wachovia refunded half of the $210 NSF Fees and completely ticked this Customer off at their obvious immoral actions (bordering on Illegal if you ask me!).

I was just charged $315.00 for overdrawing my account by $13.45. To me this is a complete rip off. I work for a bank and have previously worked in customer service. I completely understand bank's wanting to have a system in place that keeps consumers from taking advantage of them. But I don't understand how it is ethical or even legal for a bank to charge me ridiculous amounts of money based on arbitrary posting procedures designed to screw me in the first place.
I made a cash deposit at an ATM on a Saturday morning and made several small transactions after this. Seeing that I was going negative, Wachovia's systems posted my debits before my credit, in addition to withholding items from my available balance so that I would overdraw even more. For a total of nine items that added up to $13.45, I was charged $315.00. This is a pathetic shame. And the only thing representatives could say is that I need to be more careful with my money. This is an ironic statement for a bank whose apparent over-extended payroll line of credit has caused them to require an emergency buyout.

On Oct. 29th, I went to Bank of America to cash a check (business check no less) that was written to me and drawn on Bank of America and the teller asked me if I had an account with Bank of America. I responded No? She then proceeded to tell me that there will be a $6 charge for cashing the check because I am not a customer? $6. That's more than what Stop & Shop or the Check Cashing place charges. So here is what that means. If you are a customer of Bank America, you're probably already paying some fees for keeping your account, etc. You write a check to someone and Bank America takes $6 of your and puts it back in their account. DON'T WRITE CHECKS TO PEOPLE UNLESS YOU KNOW THAT THEY WILL DEPOSIT IT IN THEIR OWN BANK. YOU WILL LOSE YOUR MONEY TO PAY FOR THE BANK FEES. This is just one more thing the banks can do to squeeze money from our pockets. So very sad! What they are saying is you either become a customer or you suffer.

I check my balance everyday online and noticed I was charged 3 NSF fees. Here's the deal. I have money in my savings with overdraft protection. I knew I was getting close and figured they could just transfer money from my savings to cover any checks/purchases...which they did. No problem...other than the fact they charged me NSF fees for them. WTF? I had the money, I knew my savings would cover anything that came in... Isn't this what they advertise overdraft protection for??? So I go to the bank and the supervisor tells me that it was some debit card purchase I made that they somehow authorized a 'hold' for. Huh? It does not show up anywhere... could have been anyone and I'm responsible???? I don't get it. Now if that doesn't sound like some made up BS I don't know what does! She reversed the $75 for me because I think SHE knew it was **! This is ridiculous and it seems they are just trying to charge these fees and see if the customer notices and makes a stink about it. What a bunch of crap!

I phoned and mentioned that two different companies under Trilegiant had been charging my card for over 4 months. After endless phone calls and stating that I was going to the State's Attorney's office with my findings, B of A was able to speak with reps at both businesses. TLG Great Fun and AP9 VS Home. I was unable to reach any contact at TLG and VS Home only refunded me one month. Then I got nasty with B of A, warning them of my knowledge of their affiliate, Trilegiant and it's fraudulent behavior. I got further help, but not without hang ups, and long phone wait. I believe that B of A makes a percentage from these fraudulent charges and when the consumer goes over his/her credit limit because of them, B of A tacks a $39 charge, knowing that this will happen, because most customers don't assume they are being fraudulently charged creating an overlimit!!! I believe that B of A needs to be prosecuted for it's theft.

Bank of America is a fraud. They have set up my account to where I can never get accurate information of my account balances. On top of that, the bank will hold a transaction that you make at an ATM. Meaning, if I withdraw money out of my ATM, my account will not reflect that. They will hold the ATM transaction until you have made a card transaction and then BOA will take out recognize your largest transaction instead of the order of which you made them including ATM transactions. This is fraudulent. What can consumers do? I have read page after page of complaints about BOA and their agenda to charge overdraft fees. We must do something about them. I volunteer to become the leader to organize consumers who want to see Bank of America return customers money that they have wrongfully taken.

I've used online banking since online banking arrived. I've had a Wachovia account for 3 months now and have incurred around $900.00 in NSF fees in this time. I check my balances online daily. I check them via my phone and the atm and never once did I show a negative balance. Things would be on hold but they were not more than the deposit that might be on hold. Then suddenly I have no money in the bank and I AM negative because a mysterious NSF appears even though the balance is positive and until the NSF fee was NEVER negative!
I ask and they go through this lengthy description of how this that and the other hit before this deposit etc. and can never answer my question. If nothing shows me to be negative and my outstanding debits do not amount to more than outstanding credits, how can I get an NSF fee which then really DOES send me negative? I can get no relief to this. Because of this loss of $700, I was unable to put a down payment on a vehicle since my vehicle's transmission went out and had to borrow my friends fishing truck for work, my mortgage payment bounced and now I must pay only with a money order or cashier's check for which I'll have to pay a fee.

I went to cash a paycheck from my part time job for $25.00 (since it was such a small amount I did not deposited in my checking account with another bank of course) and when I received the cash it was only for $18.00 and change and I was told by the teller that there was a $6.00 fee for not having an account with them. I was not even informed that I was going to be charged for this amount prior to cash the check. Nice way of forcing people to have accounts with them. Will never do.

Somebody needs to investigate Bank of America's policies on tactics involved when charging customers overdraft fees. This is a huge source of revenue for Bank of America and they are unethical and wrong in many of their judgments. They don't recognize transfers online when they occur. I have been a customer for many years and it's surprising how I have been treated.

All I can say is that Bank of America is horrible, thankfully I don't bank with them but my boyfriend does. They ruined our vacation, that's all I can say. Basically, we were on a cruise and we ended up in Cozumel, Mexico. We went on an excursion and we had to pay. Well, my boyfriend realized he did not have cash on him and when he went to the ATM to take money out, it got declined. Well, then we said, "Let's go call the bank"... We call them and basically they said that they could do nothing for us. We had no cash on us at all and we had to pay for our excursion. By the time we got a response from the bank that they could do NOTHING for us and we could not get access to his own money because the bank cancelled his card, it took us over an hour to get that answer.
Why did it take over an hour because 1) We got the runaround and transferred all over the place and 2) we would get hung up on when we got transferred, all to get the answer NO, they couldn't give us the money. And the excuse they gave for cancelling his card, another joke... some excuse about a third party having a compromise on his card that happened a year ago. Well, long story short... my boyfriend tried to go back on the ship to get a loan or something... and that's a whole other issue...
I ended up being stuck alone in Cozumel, Mexico with NO MONEY and just my ID and my SeaPass for the boat. We have a whole other issue with Royal Caribbean because they would not allow my boyfriend off the ship and they promised him that they would find me. They never let him come along and they basically assaulted him because they were holding him back with force for absolutely no reason. My boyfriend is not the violent type and they had no reason to push him around and hold him back. Well, anyway.... My boyfriend ended up paying $1200 (he got the money somehow with some help from people on the ship) to get me from Cozumel, Mexico over to Belize. I BARELY made it and we were reunited again.
It was a horrible experience that I would NEVER wish on anybody. We were not separated on purpose or because wanted to... but either way... we lose out. Neither Royal Caribbean nor Bank of America will do anything for us. I'm more pissed off at Bank of America for just cancelling his account just because and giving us a lame excuse as to why they cannot refund us the money. And we have a receipt proving that the $1200 was paid. It was just ridiculous!!! Just thinking about it is upsetting. I heard some bad things about Bank of America... but this has been the worst. In an emergency, they supposedly can't do nothing for you... and they just decide to cancel his account right around the time that we are on vacation in a foreign country. ** That's all I can say... **.

I am being charged fees on top of fees for overdraft when I put CASH in the bank. I can't overdraw 20.00 or they will charge me 140.00 for 4 overdraft fees for pending transactions of which were covered. The one that wouldn't be covered is 20.00 which I could see them charging 35.00 not 140.00.

Every so often, money disappears from my checking account. The balances are all changed, so it looks like nothing happened. This money is returned about a week or two later. This time, however, it was nearly all of the money I had in my account. It wasn't so much to sue over, but not little enough not to care about. I contacted BOA online, and they told me it was a bank error that would be resolved that day. Nothing happens. Call them the next day. Of course, the associate needs all sort of info, and I'm looking online at my account, but I'm flustered and told to call back with more info. The next person magically doesn't ask all of these questions, but doesn't help much and suggests that it has to do with one of my pending transactions.
Next day: transaction went through, balance the same. Later that day: Completely forgot about a purchase that I had made when I had money in my bank account, which now puts me in the red. Contact them online again - this person is very stupid and doesn't understand anything though I kept saying the same stuff over and over again. Suggest I call them. So I call again - and this person finally does something - decides to credit my account with an old overdraft fee that I had paid, so I wouldn't be in the red. Money is still missing, though. It wasn't me, it wasn't identity theft, it was the bank. I am seriously thinking about switching banks.

How about Bank of America holding a student loan check, funds clear the bank written on October 14, 2008, but Bank of American claims that the bank written on is claiming check is fraudulent, the bank it is written on says that that is not true. They will not give me any more information, they will not talk to the bank check is written. Meanwhile my account is on hold pending closure with a whopping $3195 student loan that I have no access to. PNC will not write a letter stating the check cleared unless they speak to Bank of America, and Bank of America will not speak with PNC because they do not speak to third parties. Talk about Catch 22. I am a single parent of two school age kids, any checks written on this account were charged overdraft fees.

Every time I call its toll free number, I must repeat every word I say several times even though I speaking in the most clearest voice I have since I have a speech problem. When I am finally able to be connected to keypad system of using this method, it occurs after I have wasted 15+ minutes of repeating myself and became flustered for doing so. This bank is breaking federal law governing such matters concerning voice response answering systems. According to that federal law, all automatic answering systems must be set up to say that particular option or press a certain number for that option from the start of each telephone call it receives.
I, for one, have repeated myself for the very last time while I was trying to use its telebanking system. In addition, I have made the repeated request to have all of my banking information to be completely removed for its site since I am unable to log onto for the simple reason it will not recognize my password. It has not yet honor this repeated request. It will only do two things. One, it will send me E-mail to inform me someone was tampering with my online account even though I was that person and I am the only person who access to my checking account information.
Two, it will play the blame game with me for not remembering my password correctly when it is the same password I use anything that calls for a password while I am online so I could I forget my password??? This bank does not care about these factors or any other factors since it purposely tries to make its customers' banking needs as difficult as possible all the while it is claiming to have been rated number one in customer service for seven straight years. From what has happened to me and what I have read on this site, this bank must be conducting business in La-la Land. Come October 31, 2008, I will be changing banks since I have had enough of this bank's BS to do me for a lifetime.

I recently left Wachovia Bank because of many issues. One in particular was overdraft fees. Everyone has overdrafted at least once or know someone who has. But I bet money that no one's account was closed without notification and reported to a collection agency---unless it was with Wachovia. And that is exactly what happened to me. I have since left and am now banking with a prestigious company who values its customers and don't seem to have their hand in my pocket. Please be careful if you are considering Wachovia as your bank. And if you decide to go with them, apply for a bank account elsewhere in addition.

From the beginning I thought I had overdraft protection. It seems that I did not so on or about 10/10/08 I entered the bank and applied for an overdraft protection on my checking account. It seems that it wasn't applied to my account and now I have been charged over $300 in overdraft fees in a 2 week time period. I entered the bank today, spoke to the branch manager and she wasn't very helpful. I contacted Teresa via phone, a bank representative and explained my situation to her under the false pretenses that I have this overdraft protection on my account. She was kind enough to return a courtesy $119 back to my account and put it under investigation. Obviously as an unsatisfied and disappointed customer I need my full refund back, NOT partial...

How could the Bank not 'know' the account was overdrawn? They are the ones who knew first! They are the Bank! They are the ones who sent 6 overdraft notices on separate days!
My conclusion? The Bank does know. It is their job to know. Of course they know. But they look the other way and honor small charges to overdrawn checking accounts, then collect a king's ransom in fees at the end of the sad story. The Bank knows what it is doing. This is no accident. It is a pattern of deliberate and repeated abuse of consumers and betrayal of customer trust. In essence, Bank of America processed a series of unauthorized $3 and $4 dollar loans at 100% interest to my daughter.
What is most concerning to me is the customer service rep's final statement. In an unguarded moment, she let it slip that the Bank could actually charge up to $5,000 in fees without any legal ramifications. This is very worrisome since the BANK is in charge of the very transactions and their timing, which apparently is excruciatingly precise and perfectly sequenced EVERY TIME to result in a $35 dollar fee. This is just too coincidental. I believe that Bank of America may be up to some pretty dirty tricks, and they may be playing these tricks on those consumers who are most vulnerable and least likely to protest: the young, the elderly, the disabled, and those whose first language is not English.
Think about my daughter's story: $650 dollars in fees for $100 in purchases. Now multiply that by a million customers. That's $100 million dollars the Bank churned out in pure profit for itself, simply by preying on naive and unsuspecting customers. Now think about this: Bank of America is the SECOND LARGEST Bank in the U.S. They certainly have more than a million customers. It is reasonable to assume that they probably have over 5 million customers.
Dirty tricks? Bank of America may, at this very moment, be cashing in NO LESS THAN $500 million dollars in unjustified and exorbitant fees! That's HALF A BILLION dollars folks! My only question is this: when is our government going to launch an investigation into this pattern of abuse and victimization? How long will our elected officials continue to look the other way and tolerate a Bank that robs people?

Wachovia has been ripping of consumers with their overwhelming fees. They have charged me 35.00 five times in a week and a half. My account was overdrawn ninety three cents in one of the them and they charged me 35.00 dollars for that one. I called Wachovia to see what they can do for me but they refuse to give me any credit for the first four non sufficient fees and overdrawn fees. So I accepted that and tried to make good faith with them, so I started to make small deposits to bring my account current. I deposited $51.17 to my account so far.
On 10/21/2008 I checked my acc. again to see what was happening, and I saw that they charged me another 35.00 dollar fee for check #** which was already presented on 10/09/2008 and I did not have enough money to cover it, so the co. of which I wrote that check to tried to cash it again on the 10/16/2008. Now Wachovia is charging me a second fee for that check. Times are very hard right now for me and my family and I think it is very unfair of what they are trying to do to us. If they knew that there was not enough money in my account, why would they allow the check to go through. Please I am asking for your help in this matter. Thank you so much.

I waited an hour and 45 minutes to open up a savings and checkings account with Bank of America. I wanted to cash a check that is written out to my husband and I and I even showed the account specialist my General Power of Attorney. My husband is in Iraq. She left to speak with her manager to see if I could cash the check into the accounts that I wanted to open. And she came back to tell me that I could not cash it. I only wanted to open a savings and checkings in my name with the check written out to my husband and I. I don't understand why I could not cash the check if I have General Power of Attorney and seeing that Bank of America is affiliated with the military!

My son, 19 years old, is a Bank of America customer as am I. He recently received a fraudulent check from a Mystery Shopper scam (not a cashier's check) in which he was asked to deposit for cash (it was made out to him). His task was to get the cash and wire it to an address in Calif. (we live in CA). After this, the check bounced (a scam of course) and BofA says my son is responsible for the money. They gave him $2725.00 cash the second he brought in the check and said that the system did not alert them that they should wait for the check to clear (he had $41 dollars in his account or even less and has overdrafted before). The teller, the branch manager (Olga) and the Fraud Agent (Angel) all concur that there is nothing wrong with their system. Unless the system alerts them, the customer is responsible for the check if it bounces and on top of that there is no limit to the amount of money that someone can get right away without waiting for the check to clear. The ATM, however, only allows you a certain amount because they don't have the capability to check the check, no matter who you are, but you go into the branch where they have the ability to discern a potential issue and you can do anything you want.

Bank of America placed a hold on a payroll check I had deposited. So I went to the bank and asked why this hold was placed on the account. No answer was given but the hold was released. However, during the hold, I had incurred overdraft fees. I received a letter stating that I was entitled to have these fees reimbursed to my account. I went to the bank and asked for the fees to be returned and they said that the manager was the only one who could do it. The manager's name is Fernando **. He said he put in a request to have the fees returned to me. He called and told me that seven of the fees I had incurred would be returned to me on Monday, October 20. However, they were not returned to me at all. I called Bank of America customer service and they said since I spoke with him personally, that I would have to deal with him to get the fees returned.

Bank of America purposely charged me late fees, when one of customer service representatives made a mistake on my automatic payment. My mother's payments went thru but mine didn't. They charged me late fees for three months and they LIED AND LIED. Their telephone representatives lie so much. They told me it was because my minimum payment date was moved and that I charged my card, which I never did. I closed the account. I have been with them for years and they tried to rob me. They are thieves and I curse them and the company. I have been stressed and worried because they froze my mother's account too, who has been making her payments on time every month. They have also increase the interest rate. Bank of America needs to be investigated!

I am utterly disappointed with BOA for nickel and diming me for my hard-earned money in such a depressing and economic turmoil times. I recently signed up for overdraft protection with the understanding that I will be charge $5.00 per transaction. In good faith I have signed up for online banking & statement notification, which I oftentimes overlooked. Nonetheless, I started paying attention to my statements by requesting paper statements only to be faced with a rude awakening that I am bargaining for 20.99% OV transaction accumulated balance. That I haven't received one mail notification about, this is very much unethical and not very much in line with ethical banking regulations.
My last statement minimum due was $85.00 with whopping $53.14 finance charge, for the past couple months I have been making huge payments however my balance never reduces. I have contacted them requesting that my account be reviewed and corrected and to date they have not made any adjustment to my account. I am not pleased with the BOA hidden agenda and unethical charges to me, need my account to be properly refunded. I felt as if I was deceived, all the information wasn't presented to me instead I had to discover it on my own when my credit card bill has mounted to its highest peak.

I noticed that there were a couple of PENDING transactions that caused a negative balance. I quickly deposited the money (CASH) to cover the amount. Then they held the deposit until the overdraft kicked in. Because of the overdraft charges, the account balance was again reduced to not cover other purchases that were pending, therefore accruing additional NSF charges.
I also notice that Bank of America will hold purchases and deposits in pending status until it is most profitable for them. My paycheck is always the same amount funds from work's account is available. When there are no pending purchases, the deposit clears in one day. When there are pending purchases, somehow, mysteriously they will hold the check until a negative balance is achieved.
Once a paycheck I had deposited had cleared and the money was even available for me to withdraw from the ATM, but they put the check back into pending status for a reason they couldn't explain. When I asked the CSR why it showed otherwise on the online banking account activity page, the CSR indifferently said: "The online banking is not accurate. It can show information that is different from our system."

I hired a debt negotiator through a family friend that takes care of our finances. Bank of America and the negotiator came up with a settlement I was comfortable with. I sent Bank of America two checks as agreed upon that were processed but did not go through because the funds were not finished being collected between my bank and another institution. My bank informed me Bank of America could reprocess it and the funds would be released. I made arrangements with Bank of America to reprocess and they reported it would be scheduled on October 2, 2008. I again confirmed this date with a second Bank of America rep. As you can tell, I was confident this ordeal would soon end.
On October 15, I received a letter stating that the deal was off due to nonpayment. The payments were never reprocessed due to THEIR error. I dare say that it is an 'intentional' error; in the past, I have attempted to work on payment arrangements with this Bank only to have them make 'errors of convenience' which have left me in the negative for hundreds of dollars and has made me change my bank account. Once the erroneous amount of money has been collected, this bank refuses to give the money back even when they admit they have made the mistake. Their reasoning - because they are collecting a debt, they will keep whatever they have erroneously taken and will continue to 'tap' into funds from my personal bank account. I would love to know how a corporation such as this one has the law on their side?

In June of 2008, I called Wachovia Mortgage to refinance two properties that I have with them. I started working with Mr. **, who would never return my calls, ignore my messages and never let me know what was going on. During that time the values of my properties were going down. When I asked him what was taking so long and why he wasn't answering my calls, his reply was that his daughter is more important than this job. I asked to be switched to another broker and I got Gary **. Gary could not get my whole complete file from Mr. ** so he asked me to fax the same documents. Gary also ignored my calls for weeks at a time, then he would explain to me that he's working on it and that he wants to make sure he doesn't lock me in at a high interest rate - SO IT WAS ALL IN MY BEST INTEREST THAT I WAS BEING IGNORED and the value of my property depreciating.
Then one day I get charged $650 for documents that were never filed and appraisals that were never done!!! When I called, I was assured I would be refunded all of the charges. I spoke with a supervisor, Richard **, who assured me (I have all his calls and e-mails) that I would get the charges credited back to my American Express...THAT WAS THREE WEEKS AGO!!!! I was credited for one of the properties and the appraisal. They still owed me $275. Richard assured me repeatedly that the $275 would be credited within days. Every day, he would say call me tomorrow and it's been three weeks. Today he sent me an e-mail asking me what other property are you talking about??? Do they NOT have computers? Do they NOT have access to all this information and what they charge customers?
They are the WORST BANK I have ever dealt with. I cannot believe what they are doing to people, especially during this economy. I have been waiting for the credit for three weeks!!! And now he's asking me what other loan???? I will NEVER work with Wachovia again! I will also inform everyone I know of all the emotional pain and financial stress I have gone through due to their unprofessional behavior.

They lost my deposited check (Sep. 26, 2008). I deposited to my checking account back in 09/26/2008. They never credit into my account. They made overdraft fee keep charging. Even found my deposit credit with banking manager - they not giving me the credit. Consequences: Overdraft fee $150.00. Missed work, lost client, missed client appointment. Specially, today's my teller saying she is the operation manager. She never help me and treat so bad. I want apology from her. Deeply.

On 10/04/08 I used my debit card for a purchase for $1.55, that showed online instantly. On 10/04/08 I used my debit card for a purchase of $7.99, that showed online instantly. On 10/05/08 I used my debit card for a purchase of $1.00 that showed online immediately. After these 3 transactions it said I had $.32 available. On 10/07/08 I was issued 3 overdraft fees for $35.00 each. I contacted Bank of America to see why I was charged these fees. They claimed that a purchase I made of $23.39 on 10/06/08 by credit hit my account before the debit transactions resulting in me being issued these fees and according to my online statement this was absolutely incorrect. It had to be incorrect because I have the receipts showing these were debit purchases made before I made a credit purchase on 10/06/08. So on 10/07/08 they sent me a card with 3 insufficient fund transactions and now refuse to remove them.

My husband and I entered into a contract agreement with Boutique Resort La Jolla in Mazatlan, Mexico on December 17, 2007. We and the merchant were going to do an even exchange for our timeshare in Virginia Beach for 27,500 fractional owner ship points. The merchant was to sell our timeshare by June 17, 2008 or we were entitled to cancel the contract and receive a full refund of our earnest money down payment. The merchant required a 50% down payment with a new application for a Bank of America credit card. The merchant's bank was Santander Serfin, who processed the credit card application. Bank of America purchased 24.9% ownership of Santader Serfin in March 2003. So this business deal was very cozy for the merchant and Bank of America.
On December 27, 2008, I received an email from the merchant stating,"The state law in VA Beach seems to complicate things for us a little." That was when I began to feel uneasy about this deal, but I knew we had a written contract. The contract stated that we would not have to start paying the credit card payment to Bank of America until July 12, 2008, which would have been after Boutique Resort La Jolla had sold our VA Beach timeshare. In January 2008, I received a bill from Bank of America for 1% interest on the earnest money deposit. I called Bank of America and requested that the payments be deferred pending the sale of the VA beach timeshare, according to the contract. Bank of America told me to contact Boutique Resort La Jolla and ask them to defer the payments.
Boutique Resort La Jolla refused to defer the payments. I started making payments until March 31, 2008 when Bank of America refunded the entire earnest money deposit and my monthly payments. The merchant did not sell the timeshare by June 17, 2008, and not only had he submitted an email admitting, "First of all, you are right in not being delivered what was promised." The merchant continued on in the email, requesting receipt of the remaining balance due on the fractional ownership points. Keep in mind we had a contract so even though the merchant breached the contract, he still was looking to be paid. We had notified the merchant of the contract cancellation by US certified mail, return receipt requested and email. We had to pay an attorney another $500 to reinforce the cancellation of the contract with the merchant.
We sent the merchant's email to Bank of America when we requested that the earnest money deposit be credited, as per the contract agreement. Bank of America said that there was nothing that they could do because the merchant had stopped responding to their inquiries. So, we were scammed by Boutique Resort La Jolla and Bank of America. I have discovered the Consumer Protection agency in Mexico called PROFECO. I have submitted all my documentation to them in order to seek a resolution with the merchant. It is illegal for the merchant to have us sign a waiver to the 5-day "cooling off" period that is federal law in Mexico, this too the merchant required.
PROFECO has a very helpful website, which warns visitors about timeshare scams. PROFECO also has published a handy pamphlet that can be downloaded, that I wish we had read before, encountering Boutique Resort La Jolla. Bank of America recently bought out Merrill-Lynch, with the money that was acquired through fraudulent business practices such as Boutique Resort La Jolla. My husband and I have closed all of our accounts with Bank of America. I will be a walking advertisement for their corruption for many years to come. We (My wife and I) opened a Free Checking account on 7/23/2007. At the beginning we put a required minimum of $100. ** then talked us into open some kind of Crown Account and told us that it would be free too if we opened a credit card account with the balance of the credit card more than $5000, then it will be free. He made a call and told me that I was qualified for a free monthly fee. We opened 2 accounts (my account and my wife account) and with over $200 each account. We did not do any transaction since then and today we came to know that all of our money have gone since they took 20 dollars monthly fee to both of our accounts. We wanted everyone to know that Wachovia is a good bank but with people like ** misled customers in order to get commission. This way is an unethical way.
I hope everyone should know more about this individual to stay away from him. What he said and what on paperwork were not the same. We were trapped with many papers to sign in the offices and with $200 we did not really spend time to review it. Wachovia's ATMs are ridiculous. Firstly, they hold onto your card while you make your transactions, unlike Chase ATMs which spit the card out immediately after you insert it. Secondly, they only require you to put in your pin number ONCE, regardless of the number of transactions you put it. What do these two things lead to? ROBBERY. What happened to me yesterday has probably happened to hundreds of busy, late, rushing people in New York City. To make a long story short, I took out $20 from a Wachovia ATM and ran out to meet my business partner. Two minutes later, while online for Starbucks, I realize I do not have my ATM card and that it's back still IN the Wachovia machine.
I run back to get it and (who I thought was) a nice woman told me she had given it to the teller. I went to the teller and gave her my ID and she gave me my card. However, today my account shows $200 taken out of my account two minutes after I withdrew my $20! The nice lady had robbed me of $200. Luckily, Chase is kind enough to reimburse me for my losses. But when I went to back to the Wachovia to tell them what happened, the tellers clearly did not give one **. In fact, the manager told me its happened several times before. They told me they could do NOTHING for me and that I had to go to my bank. They wouldn't even check their security camera from the day before to try and identify the person who stole my money. It's not even about the $200 (obviously it could have been much worse). But the fact that Wachovia made it so easy for this to happen because their machines are so insecure and then that they didn't even care. Moral of the story - WACHOVIA IS THE WORST.

I was told a check cashing fee of $12 would be required unless I wanted to open an account. Why would anyone want to open an account with a bank which will not cash its own checks unless you paid them???

I just received an email from Bank of America telling me that my account is going to be charged $170 for 4 items that it says are being returned for NSF. I have printed my bank statement out and they are not insufficient. I have also deposited money today to help clear two transactions that just are pending, but now will be charged NSF fees for those as well because of the $170 that are being taken out first. So now I will have $230 worth of fees taken out and my account is now well overdrawn. I have three accounts with them and now all three accounts are overdrawn with similar incidents.

My stepfather received a dividend from the Eton Company which he receives regularly and deposited into his Bank of America Account in good faith. We went into the bank to find out why he couldn't use his ATM card and was told to wait until the next day because the full details were not available. Today, they tell him that it was a fraudulent check and that he is unwelcomed to do business there. The funny thing is that his family's trust is through them and he has to receive funds from them. It sickened me because he is an elderly man and just received a loan that is suppose to be sent to that account and we have to attempt to open an account elsewhere without access to his account.

I believe bank of america has an internal system that extracts money from consumers. I view my account one day. Everything is cleared with all deductions. The following day after a withdraw they reserve the entirety of my transaction. I would rather have a thief because at least I have some type of right to clear the problem. But this financial institution able to manipulate our transactions reversing them back and forth as they see fit. This institution is given a license to steal consumers. If there was an audit by a honest regulatory they would see the corruption of "bank of america".

I have been a BoA customer for 2 years, plus I had an account with them a few years back as well. I share one account with my husband. Recently, we were the victims of a check fraud scam. Because we deposited the check without knowing it was fraudulent, they are closing our account. Now, here is where I am really annoyed by BoA. I have a separate account with just my name. I have called 4 times to ask if my account will be closed as well and I get a different answer. One person says the system reports it will be closed. Another says there is no notation of this.
I am supposed to be getting a direct deposit on Friday. No one of their competent Risk customer service reps can tell me if it will close or when. Anyone who has had their account go into closure knows that the account is debited $888,888.88 so if this happens before my direct deposit, I will not be able to access my money. I have already requested to start receiving live checks from my place of work, but this could take time to set up. So basically I may or may not be without any money for the next two weeks. No one can tell me. What kind of company are they running?

The bank will not allow my company to show a gross amount of cash deposit less cash and then the net deposit. They want the money in hand regardless of any cash due back shown. When they screw up and forget to give the cash back they cannot and will not fix the problem. Last time it happened it took me 2 months to get resolution. Albert ** is the so-called branch manager but he has no idea about anything to do with banking or customer service. He's rude and I'm the customer.

I'm not going to bore you with detail, what didn't happen to me with this bank. I was punished with a closed account after I deposited over $400 into without them notifying me. Then told that I would not receive my money for almost a month because someone wrote me a bad check, and they didn't notify me about it until it had already entered Chex systems. I went to the extreme of even paying the money for the check that was written to me and brought a letter in to prove that it had been paid in full and still they would not release my money after being deposited with the slick words of it was in the process of being closed. Didn't even get an apology or the correct number to Chex systems for that matter. Don't have the time to sit on the internet and search for a way around it, but they VALUE their customers! I'd hate to see what would happen if they didn't value their customers. Send help!!

We had a mutual fund (Floax) a very safe one that a Bank of America representative helped us select. I noticed, recently, that we have lost a little more than we should have - so I checked the records online about transactions. First, Bank of America merged my account into another Fidelity Mutual Fund without my notice...not an email...not my consent...not a call. $830.00 is missing... I believe that they took the money up front as a percentage for the new fund - I am shocked and will contacting an atorney if Bank of America does not correct this situation.

I went to make a deposit on 10/2/08 at 2:27pm. The check was for $4,096.00. I was going to deposit $3,096. After waiting for about 15 minutes the teller said that I had to deposit the full amount because of overdrawn of your account for the last six months. I did not question the teller because it was only one person working the drive through at that time.
However when I got home that evening, I call 1-800-922-4684 and spoke with a representative. I asked as a customer why was I never informed of this before? I felt as a customer of Wachovia this is something that you don't wait until the day of to take action against the customer. I had nothing but good comments about Wachovia Bank but of course that will change. I did not agree with the way that this issue was handle. I did asked for something in writing about this policy to be sent to me. Thank You.

I have just recently opened an account with BOA. I wanted a paperless account so I opened my account online. This was suppose to be a Direct deposit account. First I was given the wrong routing number for my DD and my payroll check was lost in limbo on 9/26. I was issued a new check from my employer on 10/1. I cashed my check at Citi where the check was drawn from. BOA is right across the street from Citi so I went to deposit 800 dollars of my paycheck into my account. My $800 cash deposit is being held due to suspension of fraud on my behalf. I was told that my deposit would be available at 12am 10/2.
I checked me balance early morning 10/2 it was negative $69. I immediately called customer service and they told me funds were hold. I went into branch that I made the deposit and was told that my account was put on hold due to suspension. I could not get a straight answer and Victor the customer service rep was very nonchalant and rude. I was assured that the money would be available 10/3 at 9am. Needless to say 9:25 10/3 there was no deposit. I am distraught at this point because my hard earn money is being held without any real reason.
I called customer service again and spoke with Kathy. She implied that the money that I deposited was somehow bogus and proceeded to interrogate me as to where the money came from. I was left feeling like a liar and thief of my own money. I then spoke to a supervisor that said that they were verifying the funds and my funds would be on hold until 10/9 or sooner to call back on 10/4. Okay, so I called back on 10/4 and they still have not released my funds and now I was being told that there is no release date available and no one from the legal department was available. I have bills outstanding that are not being paid due this hold and BOA said that would send apology letter to the bill collectors. As of today there no insurance that my money will ever be released to me and I am beyond devastated. I have my receipt of this deposit but it means nothing, Victor did not even acknowledge it.

Opened small business account 8/8/08. At that time, both BOFA and I were unaware that my previous bank did not clear a dispute out of Chex Systems. Next, on 10/2/08 I made a cash deposit of $1000, which was accepted; teller indicated I had to call Customer Service number as well. When I did so, I was informed that my account had been closed due to an alert (which was an error) from Chex Systems, a database which posts alerts regarding problem accounts to all banking institutions. When I spoke to 3 different customer service reps to ask why they had accepted my $1000 deposit, and whether I could go back same day to retrieve it, they rudely told me no and I'd have to wait 15 days after the account was officially closed 10/21/08 to receive a check from BOFA back. In the meantime, my office rent check will be returned. I am a one-person business and cannot afford to lose $1000 until the middle of November when BOFA favors me by returning my funds!!!

I have had tons of complaints about them how they over charge my bank account for over drafts for the past 2-3 years. I have to fight them all the damn time. I have been homeless since Feb. 2005. I have moved around within the past year. Had troubles with them while in Chicago about my account on several accounts.
This last time I had problems back in May and June. They overcharge my account. I try to get them to drop the fees but wont change. I had traveled around the several states and wasn't aware that my account had been overdrawn. Apparently, the place that I had gone to uses a different type of paying system. That it doesn't show up to the bank when used that day or even 4-5 days later.
Then start the extreme overdraft charges. I am still currently homeless living in my vehicle. I am unable to afford for food, shelter and daily necessities. The Huge problem I am having is that I do contact my parents time to time to tell them I am alive and ok. But, the Bank of America has threatened my parents that I am currently living with them. And I am not. I had left their place in June 2008. They have called numerous times and wont leave a name of message for me to contact them. This has to stop for them to keep threatening them.

I went to Wachovia Jacksonville, FL branch with my wife to withdraw some money. I asked her to give me all 100s and if not please get from the vault. She asked me that am I in the account with my wife. I told her NO. And then I was told that my wife is the only one who can speak since I am not in the account. I asked her if I can talk to her manager. I told her almost 3 times to get your manager but she totally ignored me. I have more than 200K in many banks under my wife name and I have never been treated like this in the past. I made my biggest mistake to have my money in this bank. I am glad this bank is going down.

Approx. 2 years ago (2007), I received a bonus check from my employer. I endorsed the check and gave to my wife (Kelly **) to deposit into her checking account. Kelly also signed her name under mine. The check was deposited. Approximately 1 week later, our account was frozen/closed as my wife was being accused of check fraud.
Due to non-payment to our lenders by Bank of America, we encountered late fees, return check fees, and subsequent problems with paying our bills as well as our funds being tied up until we could open a new account with SunTrust Bank. Last week 9/27/08 my wife and I set up an account with Suntrust Bank for our 7 year old son. upon doing so, Suntrust found that My wife (Kelly **) was reported to ChexSystems (by Bank of America) as a suspect fraud thus causing our new SunTrust Bank account to be frozen and we are now going through this again. We have made several calls to BOA risk management and have been basically treated like criminals and told that we would have to clear ourselves through ChexSystems because of BOA's false accusations.

I have tried the entire day to access my online account I have with this bank, only to be told wrong password with each attempt. I also tried to reset the password with each attempt, only to receive that same error every single time. I made several calls to the toll free number for this department, only to get the same solution each time with one exception, which finally led to receive the access PIN I needed to reset my password, only to get the same error message once more. I was even told there is a block on my screen name which I did NOT authorize to be placed on my online account, which also caused me to have additional unnecessary trouble as well.
This bank desires its customers to have access to the Internet so they can use its E-banking services. It also desires for its customers to have a form of broadband Internet service so it can help customers with such problems, without stopping to realize customers who live in rural areas may not get this form of Internet service due to their locations. They, the customers, can only use dial-up Internet. In addition, this corporation desires for its customers to have a separate telephone line/number for dial-up services. People like myself can barely afford to pay for one telephone line/number due to their limited incomes, much less any additional telephone lines/numbers. I, for one, will NOT go through any unnecessary expense to satisfy its desires for these matters, when it should realize certain customers who barely have have the money to pay for life's basic needs, much less to pay for life's luxuries as in additional telephone lines/numbers so its customer service department(s) can have a much easier time dealing with customers' concerns. Until this corporation have a complete comprehension about these matters, it will continue receiving complaints on top of complaints.

I went into Wachovia bank in April 2008, I ask about investing my life savings of $145,000.00. Mr. ** their financial advisor lied to me. Told me he put my money into a very safe investment. I ask him not to put it into the stock market or any long term. He told me it will not go into the stock market or anything risky. My money would be safe and I would get about $700.00 a month in interest never received a dime of interest from April until this day. I ask for all my money back. He said I have to sell your stocks. I said what stocks? He also put me into Metlife.
I had to call Metlife. It took me about three weeks to recover only part of my money. I lost about 10.000.00. He lied to me over and over again. I did not sign any contract with him. When I ask him about that he said it was word of mouth. I am 61 years old, this person deceived me. This man took advantage of me. I did complain to the B.B.B. five times. Wachovia said they were done with me. B.B.B. put in the complaints. Said I should get an attorney. They did all they can do for me but I cant afford one...

Well my situation is similar to the how many other folks complaining about Overdraft Fees. It's ridiculous. You get charged a fee then any payments you have made since are charged a fee due to the prior fee. It's robbery. I believe Congress needs to somehow get involved in this. We have enough problems in the economy and now another reputable company is not helping the situation. Someone needs to exploit this on the news and make this bank consider changing the way they do business. To me they are putting their reputation on the line.

The bank overdrafted my account for fees when there was money in the account to cover the use of my debit card. I printed the documents to show the bank. Their system showed something totally different than what I printed from my account on the web. The bank told me it a guideline and not use it. I started having problem when BOA took over LaSalle bank. There was money in my account and I have proof of what I printed out.

For the past 3 years I have been cashing my paycheck at this branch, drawn on your bank, and never had any problems doing so. I have even paid the checking cashing fee your bank requires of people cashing their payroll checks drawn on your bank, at each visit. Im not even sure my school district has agreed to this fee on their employees.
However, today I feel discriminated against because I was made to feel so unwelcome at your bank. Without a doubt your personnel were so rude and embarrassing to me as a teacher, and potential customer, (as well as their attitude), that I will not now or ever be a customer of your bank.
Where do you get your employees from? Jail? Gangs? Bottom of the barrel collection agencies? Just what kind of training do you give them? How unprofessional and embarrassing for Bank of America, and how this will be looked on by others in the banking industry or anyone doing business with your bank.
Cashing a check drawn on any bank of the same name as on the check with valid identification is not a courtesy service. Do your employees understand that: Under UCC 3-502(b)(2), if a bank taking a check over the counter fails to pay that check by the end of the day on which it is presented, the bank has dishonored the check. Assuming that the check is otherwise properly payable and there are sufficient funds in the account to cover it, that dishonor is probably "wrongful."
Thus, any bank's customer could maintain an action against it under UCC 4-402(b) for the damages caused by that dishonor, including potential consequential damages.
1. I don't speak Spanish, most if not all of your tellers were speaking Spanish. Perhaps they don't understand English well enough to cash a payroll check drawn on your bank.
2. I was made to be embarrassed while the teller discussed loudly with the floor manager, who also spoke loudly, about how I did not have an account at their branch.
So even though I had several valid identification pieces including my finger print on the check as well as my drivers license, Social Security card, teacher identification card, gym card, medical insurance card, library card and more, that they were not valid enough.
3. They finally cashed the check after I asked them if they were refusing to cash a payroll check drawn on your bank and because the line kept getting longer. Saying loudly that they would not, in the future, nor should they now cash my paycheck drawn on your bank unless I opened an account.
I just want to repeat that until today I have never had any problems cashing my payroll check drawn on your bank. If this is how your bank treats their costumers, it is a wonder it is still in business.
I am going to make sure my school district, union, family, friends and others know of the shabby treatment I received by your bank.

Honestly, where do I begin? The question is what happened? Perhaps the question should be what has not happened? My husband and I have a joint account,he makes no purchases on the debit card nor does he write any checks, he perfers to get withdrawls from the ATM and use cash. He has direct deposit set up through his employer and faithfully every Wednesday night at around 2am (according to BOA) his money enters the account but is not accessible until 9am that morning. Now I'm not writing to say BOA forces me to write a check on Monday to pay the electric bill while hoping against all odds that the direct deposit makes it through the bank before the check does, all I'm upset and severely uneased about is that they charge overdraft fees ridiculosly.
There have been times where the automated system would say I had available funds of $150.00 (for example), I go and write a check for 151.00 and the next thing I know, that $1.00 overage cost me 35.00. I've had a purchase of a 1.95 before and that 1.95 cost me 35.00. Is this not illegal, it has to be, somewhere somehow. I believe we pay at least two employee's salary because they get us with at the very least $300.00 to $400.00 a month.
I,ve been doing some research on what I can do about this. We barely have enough to eat with on any given week, two kids in highschool and parents we have to help with their RX needs. It's not fair to work 10 1/2 hours day, 5 to 6 days a week only to realize you're just working to barely survive and pay overdraft fees. They say they start from the largest item and work their way to the smallest amount...That's theft...no matter how you twist your words, theft is theft! So if I have $ 15.00 in the bank on Monday and I make a $5.00 purchase on Monday with my debit card, and write an $11.00 check on Tuesday and it clears on Thursday, BOA says they cleared the check that was written on Tuesday, on Thursday and the debit card purchase then becomes an overdraft because it's processed on Friday...What?????
I've called and complained and explained why I felt the charges were unfair, they refuse to credit the fees back with a quick follow up of Thank you for being a loyal and valued customer of BOA. Loyal, I am, valued...not hardly. I've done some research, and I've discovered that by taking BOA to small claims court, I could possibly get all overdraft fees wrongfully taken, credited back to my account, which is by the way, well over $1000.00 this year alone. I'm tired and am at my wits end and my last dime... BOA can no longer take my last, They are treating me and my family like we have no value and contribute nothing to their buisness. I've talked to several others and we all decided that opening up a new account elsewhere would most likely be within our and our families best interest. We can no longer afford to give our hard earned checks to BOA, it's just not feesible.
Several occasions have occured, every week for the past 2 to 3 months or more we are hit with no less that 200.00 in overdraft fees, this is on a weekly basis it seems, we then can't pay our vehicle insurance, car notes, loans or utilities, we always behind on one bill or another because we're robbing Peter to pay Paul...all because BOA has been robbing us.

Meanwhile while waiting for the holds to expire and I could use my $4,400 I had written checks thinking the money would be available to me because it always had been before. I have received 16 overdrafts because the checks come in, fee, returned, fee, and tried again, fee and returned fee. That is $560 I don't have. I have stopped automatic deposits, taken my money elsewhere to a bank that knew of MOA practices and opened my acct!
Atleast $560 of fees for not having the money available while they were on hold 8 days.

According to my online statment 5 bills had cleared on 9/18 and i had paid these on 9/16. 2 days later i was charged an overdraft fee totalling $175.00 because a check came in after that and there was not sufficient funds. You would think they would charge me an overdraft for that one check rather than going back in and charging me for all the others since they had cleared already and i had received confirmation numbers for them. It's obvious they chose to charge me $175.00 for 5 payments that had already cleared after the fact in order to make their money rather than one for $35.00.
I thought it was only me going through this but i have spoken to several consumers that have gone through this and i recommended this bank no less. On a regular basis this bank has cleared payments i have made over the phone and indicated this online, then turned around and placed it in the pending file which is unfair to me, its deceitful on their part.
i had to pay $175 in overdraft fees.

my mother who is 68 years old, speaks broken english and was making 600 dollars monthly goes to wachovia for a home equity loan and speaks to nikki and was approved for a no doc loan amounting 225 thousand dollars with a payment of 1500 dollars monthly. she is promised by nikki who doesnt speak spanish that she would have credit life attached to her loan in the event my father died that the loan would be paid off.
my father was earning a about 4000 monthly between retirement and a second job. he was not on the loan at all because of his credit score. my mother was happy until my father passed away and finds out that there is no provision to credit life that included my father.
now my mother is facing forclosure for trusting a loan officer at wachovia. my mother has at least 6 other senior citizen spanish speaking friends that were tricked by this same loan officer on her no doc closings. how could a bank loan that kind of money to someone knowing that she could never pay it.
my mother is going completely out of her mind over this and her 780 beacon scores is now ruined.

On 9/19/08 my paycheck was direct deposited into my BOA checking account for roughly $1300.00. I took my girlfriend and her son out to dinner at TGIF and spent $54.00. I paid my AMEX bill which was $750.00 and a few other items that totalled around $125.00. How did EVERY transaction I made on 9/19, except for the $750 to AMEX, bounce?
As of 9/21/08 my account had a negative balance of 142.73, from five charges the I shouldn't have made with my BOA card but my AMEX card. That's a mistake that I'm fully aware of and take full responsibility for. After the five overdraft item fees were assessed, I managed to get Customer Service to remove two of them. I put $143.00 back into my account and, after all was said and done, I was only $68.00 in the red. This was on 9/22/08. On 9/23/08 my account was charged an additional SIX overdraft item fees to bring my account balance to a whopping -$341.00!!
I went to my local branch, after trying to reconcile on the phone with Customer Service. I learned that BOA keeps a different ledger of your account versus what you seen online. All of my transactions on 9/19 and 9/20 were approved via my online statement, but the bank's version of my statement was different. They showed my 9/19 and 9/20 transactions failing because the retailers/merchants did not close out their registers until 9/22/08. I asked for a copy of their records so I could compare to mine and I was advised that they do not share that info with the public. I'm not the public, I'm the account holder in question!
I feel what they have in their system should be reflected online so the customers have a better understanding of what's going on and all confusion will end. I thought that once you made a purchase the amount in question would be in a hold status until the retailer/merchant totals out their registers and collects the fees. And how does a transaction made on 9/23 supercede a transaction made on 9/20? BOA uses these deceptive tactics to milk an extra $35.00 from each of their customers. This practice is very lucrative to BOA, but very costly to BOA customers.

Wachovia closed my checking account without contacting me. When I arrived to the ATM to make a deposit it stated that my bank card was not valid. Before August I called Wachovia's Customer Service line to explain why I had not paid an overdraft fee of $76.16. I had lost my job and was starting a new job. I walked into a local branch to settle the payment when an account specialist stated that my account was closed and that I had incurred a $40.00 fee for Wachovia closing my account due to inactivity.
On 9/26/08 I went to Citibank to open a checking account and was informed that I cannot open a checking account because Wachovia reported me to the ChexSystems. I cannot have a checking account for five years after the report.
Wachovia lacks professionalism and do not care about their customers. I have repeatedly contacted Customer Service, Recovery Department, Managers, Supervisors, etc. No one has helped with this situation and are saying that I must pay this money. Once the money is paid I am no longer able to open a personal account. This has damaged my credit further and has put me at a disadvantage of securing my money.

We got behind in our house payments because of my husband's job. He installs carpets and they were ready to foreclose on us and my cousin, Tony **, said he would stop it if we could come up with the money (2000 dollars). So we did. We gave it to him in payments by money order. He worked for Fidelity Mutual and said "don't worry." The next thing we know, we got orders from the Hamilton County Sheriff Dept. to move. We still have not gotten our money back from Fleet and we moved out ten years ago. Please tell me why!

Wachovia issued a Visa card to someone using my SS number and name. The birth date was wrong year, month and day and they had no other ID. No cross check was done to verify the SS numbr. No Texas DL or other ID was requested. The ID thief used a Houston address whil I had moved to Saudi arabia about 10 years previous.
Although Wachovia admitted their error (and that it was common practice not to cross check on low limit accounts) and did not try to collect from me they refused to remove the debt from my credit report.

I have been trying to transfer an IRA since Aug.4 out of their hand with my financial advisor. They have supposedly given us wrong fax numbers,said information was insufficient even though we provided everything they asked for, hung up on me once when I insisted to speak to a supervisor. They are not very healthy as all the huge banks are right now.
I do not have time nor does my financial advisor to continue follow up with them and not get a straight answer. I work very hard for my money and they will not let it go! It is so frustrating. Some reps have been nice but others very rude. DO NOT PUT ANY LARGE SUM OF MONEY INTO THEIR HANDS!

I closed my business account with Wachovia on 9/2/08 and everything was fine. The woman figured everything out and gave me my money. On 9/20/08 I started receiving phone calls at my business from a Cheryl at Wachovia. She wanted my account number and said something about an overdraft. Well, I don't give my account to anyone who calls me since I don't know who they really are. Anyway, she put me on hold and said she would transfer me to someone else so I just hung up. Very annoying phone calls continued up until today, 9/24/08, some twice a day with very rude persons on the other end. I in turn proceded to be rude.
Today I got a notice in the mail that I had an overdraft of 27.52 and called Wachovia myself. I explained to the woman I spoke with about the annoying calls and rude people who were not leaving a number to reach them to confirm who they were and how they were harrasing my place of business. The woman put me on hold and checked into what was going on and told me that it seems to be an issue over $27.52 overdraft. I explained that I just received notice today for the first time.
I will pay whatever their so-called overdraft is tomorrow, but Wachovia needs to seriously do something with the manners of their collection department. I would love to post a billboard on my property to voice my opinion about Wachovia.

Started off with a simply over draft fee of 35.00. Then it snowballed into 245.00 called them, and they -35.00 after 1 hour and 30 min on hold. I live week to week, when I deposite 85000.00 3 years ago, I was there pal. This is the worst Bank I have delt with in 30 years.
Now life really stinks, do to all the other bills I have to take care of. This should not be legal. The Supervisor wouldn't give me his last name or a badge number. All I know his name was Brian.

I transfered my investment account from Merrill Lynch to Wachovia 2 years ago. It is invested in i-shares. I pay a fee for them to move the investments from different sectors based on market performance. To date they have not reallocated my accounts but have continued to charge me thousands for their service
I have lost over $35000 due to their management of my money.

Well I went into my branch at Congress Avenue on Monday I had $100 in the bank and deposited $165 in the bank so I could make some purchases to buy some items on Ebay. Well I deposited the money thinking it would deposit instantly as it was cash and the bank says well because it was after 2 pm even though it was a cash deposit the money wasnt available till the next day.
As far as I know every other bank when you give them a cash deposit it posts to you account instantly. Well according to wachovia bank they dont do that and what the did was when i made the purchases with my bank card they took the money out instantly instead of it usually taking 2-3days to come out so they could rack up NSF fees on my account then when my money did post they soaked that up in NSF fees and now I am in the negative with the bank for $160.00.
This is not right they did this on purpose to rack up fees on me and this is now the second time they have done this. Please help me. I am now starving and have no money and no way to get to work. Having to beg other people for rides and food.

On Friday Sept. 19th I had a total of $589 in an account with BOA. On that same day I made debits in the amount of $9.20 on the 20th I made debits in the amt of $94.96 and on the 21st i made debits in the amt. of $214.07 for a total of $318.23, which would leave me with a balance of $270. Now on Monday I made 2 debits, 1 for $234 and a second for $117, which would put me in the negative and an overdraft of $35 which this was done by accident. Now what BOA did was even thought those 2 debits were done on the 22nd BOA posted those 2 transaction first because according the rep. they post the largest amt. first so my debit of $4.18 on the 19th was posted last because it was the smallest amt.
Now Im well aware that because of the lack of funds for the last transaction of $117 that was made on the 22nd, I am responsible for the $35 which is still not justified. But because of their action I now have a total overdraft of $175.00. I call and spoke to a rep who told me that the charges were valid and that she could not do anything about it. I then asked to speak to her supervisor and the supervisor who even though both agree that the method can be seen as unjust still refuse to credit my account, she says the fee are correct and thats all she was willing to credit.
Unfortunately for me, I have direct deposit from my job on this account so as soon as my money hits the account theirs will be taken out first; even thought in this case I may spend $200 which would be greater than $175 and would totally contradict what they say. Can any one help me this is a huge blow to my pocket book especially in these times?
I usually pay my child daycare every two when I get my salary now with a pending debit I have no idea how my childs daycare will be paid for.

I over drew my account 1.75 on Monday night and 100.00 was deposited over Monday night to Tuesday morning. I was still charge 33.00 a full day after. The fee was not accessed and updated until late in the day after I made an ATM WD 80.00 Tuesday morning. The fee was not reflected on the automated teller nor the online banking site or I wouldn't have withdrawn. It said I had a balance available as though the 100.00 deposite had covered the 1.75 overnight.
On Wednesday I checked the onlne sight and decided to call and check to make sure all was well. It wasn't, I was informed that another 33.00 would be assessed on Thursday because my 80.00 ATM WD on Tuesday morning coupled with the 33.00 NSF fee assessment caused a -14.75. The online banking site says that I have an available balance of 14.75 no negtaive 14.75.
Now I will have to find a way somehow to get the rest of my rent money together becuase Bank of America has swiped 66.00 dollars to compensate the 1.75 overdraft. I'm 66.00 short on the rent.

I have multiple lines of credit for my small business which I personnally guaranteed. I have been keeping the bank informed of my status. Today, Bank of America siezed all of the money from my checking account, including my rent payment. Is this legal?

I am upset because for the BILLIONTH time I'm calling Bank of America to talk to them about current overdrafting fees. I made two purchases and one withdrawl on friday (one of them was my lunch run) and then saturday I made a few more purchases. I lost my debit card on Saturday and had to order a new one. So come Monday, I go to the bank to withdraw money so I can pay bills. So I withdraw $230 on Monday during my lunch (12-1pm). I leave $5 dollars in my bank account. I check my account today because I wanted to make sure nothing overdrafted, and guess what, IT DID! I saw several 2 dollar charges done by my bank that eventually overdraft me.
If you use atm machines at the gas stations or even grocery stores, not only does the machine charge you a fee ranging from $1.50-$3.00 but the bank also charges $2.00 per transaction at a nonBOA machine. This must be a new fee for them, because when I opened the acount two years ago, I was never assessed these fees. No one told me about these changes either. So I have three random $2.00 charges that I didn't even know about. So that's the first issue.
The second complaint is the way that they clear transactions. I understand that they clear transactions based on largest to smallest but I had no idea that they don't take into account. So what they did is after I withdrew money from my bank account on Monday at 12:30pm when the banks are open, they cleared that first. Then they started taking the two dollars away from withdrawing money from a nonBOA account (mind you ontop of the two dollars I agreed to pay when I took money from the machine). So they took all transactions for Friday - Monday and posted them from biggest to smallest. I was on the phone for thirty minutes with Desiree, the supervisor, asking them why they don't take into account the dates and she tells me that the consumers voted on the way it should be done. I told her I never voted for this policy and that I didn't understand why they would group FOUR days worth of transaction into one day. I told them I felt that this was a way to make money off already tight consumers. I said that this policy creates optimum cash flow for the bank while leaving us wondering how we're going to make ends meet.
I informed them that my boyfriend had spent the past three months correcting the damage the bank has done because of their policy. I agreed that they should post biggest to smallest but that they NEED to take into account dates. I informed them of the trouble that Wells Fargo has gotten in for these practices. This didn't worry her at all even when I started listing various law suits that BOA had been involved in. I told Desire that our country was in a midst of economic crisis and all your policies do is protect the bank. I told her that the bank is capitolizing on every opportunity to charge their consumers money and to make money for the banks.
Because of this I'm going to be out $100 bucks. I'm a full time employee and part time college student, so even the loss of $100 bucks coming from this weeks paycheck is a serious detrement.

Have had over a thousand dollars in over drafts with bank America. They showed the credits and on the account. Then when My house payment came in. They took all the credits out! And bounced everyone but the house payment.At a fee of $35.00 each. This happened two months in a row. There accounting is a hole new type of accounting. Never have I seen such do as we please action. No wounder they can bail out other institution for billions of dollars. They are taking money with out even doing a robbery. In there eyes anyway. In mine is the same as stealing.
They told me under the new banking law they can do this because there has been so many foreclosed houses. If they had just done the house payment. There would have only been a $35.00 over draft. Lucky there was not another recite come in or they would have bounced the house payment because of over drafts.
As a result of this my family has suffered hard ship to recover from their actions. Something should be able to be done with this banks way of doing things.

I know about overdraft fees and how ridiculous they can be. Labor day weekend, I had 12 transactions that I was absoloutly certain I had money to back them up. 3 days before any of those were done, my paycheck was directly deposited. Online it reflected that it had been cleared. However, after making those purchases, the following Tuesday I checked my account to find 12 overdraft fees. I checked my personal ledger to the online ledger to find many problems on their end. Not only to they prioritize transactions as a customer courtesy but they also didn't clear my check until Tuesday morning.
First and foremost, when I make a transaction, I never spend what I don't have. If the bank says my deposit is clear, I go forth accordingly. But coming back 4 days later and saying it had not, and then charging me 12 times, is uncalled for. I went to the bank with my ledger and the online ledger to argue the fees, to get a rude and disrespectful teller tell me, Ma'am your history reflects 6 months ago that you had many fees charged, and all of them you felt were not accurate. Well first off, 6 months ago is ancient history, I'm talking about the past 4 days.
Secondly, what purpose does that serve searching my history 6 months ago, and how does that aide in my recent complaint? Yes, I had mistakes back then, but that sure as heck doesn't dictate how I got 12 OD fees, NONE of which I was to blame. BOA decided that I was at fault for these fees, and would not (not even after speaking with 3 supervisors) refund my account any of the fees. I even pleaded saying that was MY ENTIRE check for child support, and that I would not see a dime of it now.
Single mom of 2, I NEED IT. BOA could care less. They are a monopoly bank with very little concern to their customers. They want your money, not only to hold onto, but also to keep. I have closed all my accounts, withdrawn all CD'S and Mutual Funds, not to mention had the majority of my family do the same. I'm from a LARGE family, that's a huge hit.
I'd say 30+ family and freinds withdrew their accounts in all forms. When you have well-off family... you are talking quite a few million dollars lost to BOA.

If I GO on line to pay my credit bill with less than 2 days to go to due date the sight is locke dup on my account. Since I can not pay my bill on line it will be late. This makes me subject to late fees and a raise in my interest rate. They have also made it impossible to reach some one to talk about my account and the terms of my account. I have a loan at 33% interest and no one to contact about it.

Wachovia charged me 140.00 in overdraft fees. There were several transactions that processes on the 19th of September to my checking account. Many transactions were for under 10.00. One large item of 134. In short, they stated that they pay from largest to smallest which is what caused me the fees I incurred. If they would have payed the smaller items first I would have only incurred one fee for the larger item.
I cannot afford to pay them 140.00. I am an low income-unemployed mother. I can't pay my mortgage as it is. I don't want Wachovia to close my account as uncollected funds and be placed on check systems. I need your help.

Over the past few months Wachovia has changed the way they process transactions and deposits. I have banked with them over a year and never had the problems I have had over the past 2 months. I have incurred over 300.00 in overdraft fees since August. They used to put my deposits first and now they are deducting things from my balance that still has a hold on it.
I called customer service today to inquire about yet another charge and they said it was for a charge that shows on hold, I said how can you charge me a 35.00 OD Fee for something that hasn't cleared yet. They said because it processed last night I said I have 2 other pending/hold charges why didn't those bounce. I am closing my account once I switch my direct deposit and my other automatic deposits. It's not my fault they are down money and are trying to screw everyone to make money.

Bank of america has charged me for over five times a fee of $ 35 for overdrafts. I checked on my account on the 15 th of Sept 2008 and everything balanced fine but I knew i had made some checks so I made a deposit on the 15 th at about 10 P.m. On the 16 th of sept 2008 I checked on my account and saw that my check was pending as well as other transactions. On the receipt for the deposit it clearly show that funds will be available on the 16th. On the 17 th when I checked my account again I found that they had back dated about 4 transactions for 15th of sept 2008 the day I had checked and everything was OK to have me go into overdrafts, that really hurt.
I called the girls that if what I see online is not accurate why do I need to see it anyway? If they do as they say that they are the peoples bank why can't they feel the same way we do and not charge for trasactions that didn't show when we access our accounts? Isn't only fair that both parties should be as transparent to each other so all of us can do our businesses better? I had to borrow $150 from a friend who unawarely put it all on my account and it was all taken by the bank yet it was to buy some food for my family. Someone Please help Bank of america is doing something wrong!
This transaction alone as caused a Pounding headache for the last 3 days, My family had to go without food for 2 day up to when I could get some to borrow me some more money. We are all in some kind of hardship but I hate it when big companies instead of helping the customer look for ways to empty them.
