    The nightmare began last Friday when I happen to check my bank statement. To my horror, my bank account was practically cleaned out. Panicked, I reviewed everything and did not see any unusual charges.

    To make a long, panicky story short, it took the weekend of reviewing every item in my statement to see that the Bank of America mortgage payment that is automatically drawn from my account was almost double it's usual amount. I was floored. I immediately called BOA, but it was Sunday and the CSR Service department was unavailable. However, the woman in the modification dept advised that she could not explain the change in my payment and it was a clear error. The following day, I spent two hours on the phone. My first call was a series of blame games--on me!

    BOA claimed I failed to keep them abreast of my flood insurance and thus they were "forced" to purchase a policy on my behalf and charge me $8000.. I informed CSR Rep Andrea that upon notification of this "purchase" months earlier, I faxed all the necessary docs to demonstrate that my flood insurance was still current, had never lapsed, and was renewed (same policy no, coverage, company). Then she explained I must not have alerted BOA and requested that they not modify my payments to cover this insurance purchase. Again, I alerted Andrea to the fact that I called hours after faxing the docs and was informed all was corrected and a credit would be applied. I also informed her that BOA sent me a letter confirming the same. Andrea seemed over her head so her supervisor, David, took over, who also claimed I caused this issue. After 75 minutes, David "kindly" acknowledged the inconvenience that may have occurred and suggested I just pay a nominal amount on the second half of my mortgage payment (I pay bi-monthly).

    *** no! He then advised that for me to obtain a refund, I would need to speak to the escrow dept. He could not transfer me and I needed to call back. That's nice and convenient. So I call back. Escrow says they need to confirm that the payment cleared before any money can be refunded. I had to send bank records to prove the money was drained from my account. Then they actually said that they cannot automatically transfer back the funds. It would take 3-4 days! Again, *** no. So they agreed to FedEx a check. In the meantime, I went over my account and found $200 worth of discrepancies so a second check had to be issued.

    Did they apologize for the stress, panic and migraine they caused? Of course not. And if I had not reviewed everything they would have pulled this double amount again! Plus continued with the unexplained charges. On top of this, I have had a loan modification/refinance request pending sine September and they expect me to call every 7 days to see if they have acted on it yet. There is no rhyme or reason to how they conduct business. There must be a way to call attention to this!

    They also charge an $8.00 fee per month to do automatic payment from my account. I would not have to pay this fee if I were a BOA account holder but BOA does not have any branches in the New Orleans area thus I cannot open such an account. Again, they trap you into fees.

    I am writing this because I have a complaint against Wells Fargo/Wachovia bank. I have been with Wachovia bank for the past 17 years and I have many accounts with your bank. I also have a second mortgage with your bank.I have been a very good customer and I was never late in payment. The mortgage payment was set to be withdrawn automatically from my checking account every month. In May 2010, my husband filed for bankruptcy on his own without involving myself. He had lost his job. We had requested the bankruptcy lawyer not include the house in this bankruptcy because I am the primary and I still would keep the payment.

    For some reason the Wells Fargo mortgage was gone into the bankruptcy file and the bank had stopped taking the payment from my checking account without notifying us. By the time, I realized that the money was not taken from my account, it was 2 months passed and many times I went to local branches and nobody could find my account. Nobody wants to accept my payment because none knew where the account was. They even said that because Wachovia is in the process of merging with Wells Fargo, the account must have been misplaced. Finally when I was called the 1800 number, they said it was in the bankruptcy file, I was late in payment and they notified the credit agency.

    This was not fair. The customer has the right to know before notifying the credit agencies. A soon as I knew, I paid in full and my loan is up to date and I also enrolled in direct payment from my account. I am still facing the hardship. I was trying to refinance, but due to the Wells Fargo notification to the credit agencies, my credit score is low. Before this I had an excellent credit. I requested Wells Fargo to refinance my mortgage due to the hardship without my husband's income. So far 3 loan officers tried to do my loan, for some reason they do not call me back or respond to my loan application. This is not the way to treat the customers. I always had a very good impression about your bank.

    Unlawful practices, lying, not processing paperwork, not processing in timely manner, evading our calls, not taking over bills on property, purchasing insurance for us when we thought or property should be in their name, we are getting bills still, tax statements, we have no access to property, was told our second mortgage would be paid off with this deed in lieu of foreclosure if it originated from Countrywide and our loan did.

    Now, we were told by a representative that customers were told that but it's not happening. And the collection company is still calling us on the second mortgage and nothing has happened with the house. We were promised a moving rebate check, no check received. The house is vacant and we are being ** by Bank of America! We could of had it sold on our by now. Please help! They are so in the wrong!

    Their business practices are highly questionable. Their fees are too high - $35.00 per transaction and they are unrelenting regarding accommodating their customers. I have inquired about overdraft protection in the past and they gave me a credit card. I wanted to close down my account in October 2010, and the manager of the bank refused to close down my account at that time.

    Today, I submitted to the bank manager a fraudulent payment out of my account and once again I requested to shut down my account. The bank manager informed me that he did not know whether or not that Bank of America could handle my claim if I did not have an active account with them.

    My name is Derrick ** and I reside in Corona, California. It is here that I live with my 16 year old daughter and my loving wife of 19 years. I am 39 years of age and a full time employee of 8 years at a company in Irvine where we manufacture precision investment tooling for primarily Aerospace and Medical components. My job title is: Tooling Engineer. Sixteen years ago when my daughter was born, my wife and I made a decision that it would be better for her to stay home and raise our daughter and I would be the one who brought home the money. We made many sacrifices throughout the years to make that happen. It was and still is a very good investment. Because of our decision, my daughter is now a spiritual, responsible straight "A" student with strong morals & focused goals.

    As parents who continue to survive so many odds against us, we could not be more proud of those choices that we have made. Years ago I remember standing on my balcony at an apartment we rented in Huntington Harbor and with tears in my eyes telling myself that one day I'm going to buy a home for my family. This will be a home we can call our own, a piece of the American dream. I come from a broken family and we constantly moved from place to place and I never had that security that so many people had growing up. I was dedicated to not allowing that to happen to my family. For several years we rented a small beach cottage home in Huntington beach just a mile from downtown. At the time, my place of employment was only two miles away. This house was just next door to my In-laws whom I adored. We were very fortunate to have lived right next door to family for so many years.

    It was there my wife's mother Susie passed away due to complications from cancer. Not too long after Susan passed, we were served a notice that the places were being sold and we had 90 days to move out. This news came very hard to both us and Timothy, Susan's husband. It was at this time in our lives that we decided to purchase a home. A dear friend who at the time was a real estate agent quickly set the gears in motion. As with most home buyers we looked at a few places in surrounding areas but nothing caught our eye price wise. Knowing that time was of the essence, heavy prayers set into place. Our real estate agent found a place in Corona.

    We got into the car and headed east. With only MLS pictures in our head we pulled up to the property and instantly fell in love. We were proud first time home owners within only a couple weeks of being served the papers at the place in Huntington Beach. It was meant to happen. The power of prayer! We made a great sacrifice which changed our lives in many ways. Work wasn't 5 minutes away anymore. My daughters school wasn't just down the block. Timothy was 26 miles away, not just next door. It was a tough transition but for the better. Through hard work and dedication I was able to make that dream come true for my family.

    We moved in on July 10, 2004. In the years we have lived here we have spent tens of thousands of dollars on home improvements. All of these improvements were paid for with my earnings. I believe it is the cutest house on in the neighborhood. Like so many people did when the equity in their home was substantial they took out seconds and bought cars and boats then when the housing market turned they were stuck with huge debt forcing them into foreclosure.

    In the years living here I have never re-financed even when the market was high. We took on a mortgage we could afford based on my income at the time. Now, the bad news. Reminder: All of my testimony from this point on is truthful backed by receipts, documents, dates, times and names of people my wife and I have spoken with. On May 2009, work slowed down and I fell behind on my mortgage payment by 2 months. Mind you, from July of 2004 thru February of 2009 we never made one mortgage payment late. Being behind, we immediately called Bank of America (BOFA) and explained to them our situation. We were told, "We had to be 3 months behind in order to qualify for the Making Home Affordable Program (HAMP)".

    After we had lapsed into 3 months delinquency I was asked by BOFA to fax them a long list of documents like 3 months bank statements, 6 months payroll, tax returns, expense breakdown, letter of hardship and so on. Later we were told by BOFA that "We qualified for HAMP" and that our file is currently under review. Note: We were never mailed a HAMP Packet. Two months after faxing BOFA all the documents they requested, we never heard back from them. At this time I was 5 months delinquent. I was receiving foreclosure notices in the mail and one even posted on my door, documents from Recon Trust were showing up in my mailbox and strangers were showing up taking pictures of my home.

    Perhaps BOFA had their fax machines hooked directly to the shredder. My wife and I were sick from stress and with BOFA not at all working with us, we had no choice but to hire a company to help us out of our situation. On July 2009, I did some research and decided to hire Pacific Loan Solutions (PLS) owned and operated by Jeffrey Torrez and Wassam (Sam) Ismail out of Riverside. The attorney on staff was Zachary Gonzalez LLC.

    I went to their location for a free consultation and they said they specialized in loan modifications, I qualified based on my criteria and they said they would be able to help me with a loan modification. I paid the company $5407.00 to do the work (1.5% of the total amount of the loan to be modified). Strange I thought but desperate. Over the course of several weeks I emailed and faxed them all the information they requested. Months and months and Trustee sale date postponement after another went by and nothing was happening. I was getting further and further behind on payments. BOFA would not even accept payments at this time until I came up with the full arrears.

    Months later after hiring PLS, I got a one page form letter from BOFA stating "Modifications are not an option", that our loan was non modifiable due to the fact that the investor (Wells Fargo) will not allow it. Did Pacific Loan Solutions know this and not tell me to scam me out of my money? The answer is yes. The company had an "A" rating with the BBB when I hired them and now an "F" rating. PLS shut their doors and Jeffrey, Sam and Zachary disappeared. Once again we were at a complete loss with seemingly nowhere to turn. On July 2010, after several attempts trying to explain to BOFA our situation they still were falling back on the excuse that Wells Fargo does not allow modifications, I was forced to hire another attorney. Through the state bar website we found a reputable firm, Keefe Roberts & Associates. After a consultation, Keefe was convinced that BOFA was up to something strange. We paid Keefe Roberts & Associates $2000.00, in which every dime they earned only to have BOFA send a letter to them stating that my loan was non modifiable and it wasn't an option because the investor Wells Fargo doesn't allow modifications.

    Keefe was even confused, and we started talking about different options like a lawsuit against BOFA (not an option as it would cost me $10,000.00 or more), restraining order against the Trustee sale ($2500.00), Chapter 13 ($4000.00) or Short sale, ($1500.00) or of course walk away. Don't get me wrong, Keefe is a good fair attorney but why is BOFA making me go through this nightmare? You would think BOFA would like to start getting payments from me? My wife and I decided that we want to save our home and a chapter 13 seemed to be the best way out of this mess so we took that course. I put Keefe on the shelf and went after Zachary in hopes to get my money back so I could pay Keefe for the chapter 13 fees. On August 2010, a friend of mine and I found where Zachary Gonzalez (former PLS attorney) was practicing and confronted him in a public arena demanding my money back.

    He refused to refund me stating he simply did not have it, and an argument ensued. Police were even called. Finally Zachary offered to provide me the services for a Chapter 13 and court representation free of charge. I scheduled an appointment with him and the contract was agreed upon. The contract stated that Zachary would perform the services required for a chapter 13 free of charge. I contacted Springboard and paid the $45.00 fee to complete the online certificate course for pre-petition counseling for chapter 13. I wrote him a check for the amount of $274.00 for a chapter 13 court filing fee. Relieved, I waited patiently to hear back from him. Well that's just great now, I have to call Keefe and tell him, "you know Zachary, that guy who stole fifty four hundred bucks from me, well now he's going to represent us in court".

    After notifying Keefe about what had happened I had a sense of relief that Zachary would make good on his promise and maybe things were starting to look up for us. Rightfully so Keefe probably thought we were nuts, however I had no choice and I did not have $4000.00 to pay Keefe for a chapter 13. A couple of weeks went by and I had not heard back from Zachary so I decided to leave work early and go down to his office in Riverside. The secretary of the building told me she had not seen or heard from him for a couple of weeks and a lot of people were coming in asking the same question. Weak in the knees and a stomach ache, I went home and later on found out he was disbarred. Evil forces are working against us once again. Soon after, the court dismissed the case because of non-activity.

    Thanks Zachary, and thanks BOFA! Now without an attorney to represent me in court and the lack of knowledge and paperwork it took to represent myself in court and the fact that 95% of all chapter 13 cases that are self represented are denied by the courts, I turned back to Keefe Roberts. I wrote another check to Keefe for the amount of $2000.00 in which he continued to try and get BOFA to modify our loan to no avail. At this time Keefe wanted to continue on with a chapter 13, but without BOFA. Working with us by modifying my loan and adding my arrears to the back of the loan, it seems too heavy of a burden for me. Keep in mind by this time I am $9726.00 plus numerous days off work trying to get BOFA to modify my loan when all they needed to do was help me out with my mortgage back in May of 2009.

    $9726.00 is 6 months of my mortgage payments to BOFA! Why didn't BOFA tell me that modifications were not an option up front. Instead they lead me on for months and months allowing me to believe something was happening when actually nothing was happening. Had I known up front that modifications on my loan were not an option, which I don't believe this as being true, then I could have taken a different course which would have landed me in a much better situation now.

    A simple one page form letter from BOFA stating modifications are not an option is simply not enough information for me or my attorney for that matter. I thought that BOFA by law was supposed to work with the buyer by modifying their loan if necessary, provided they have income. According to BOFA you don't even need to have an income for them to work with you. Sure my hours got cut for a while but I never lost my job! My wife and I even spoke with a HUD counselor who said she would take our information and give it to BOFA and that she would get back with us. We never heard from that lady again. Of course this letter is an abridged version and I left out many small details, but in a nutshell you get the idea.

    Over the course of the last 18 months of hell starting back in February 2009, I have learned about a lot of things that most people should never have to know in their lifetime. I understand that it was I who fell behind on my mortgage payments back in February of last year, but I never thought it would come to this. Furthermore I thought that's what the HAMP program was all about, Making Home Affordable Program?

    I am a hard working middle class American who does not rely on free government handouts to get from day to day like some people do. It was my understanding the Federal Government bailed out BOFA and set up laws forcing BOFA to use the money to help folks like myself. I was never offered that opportunity. All I ever wanted was to get back on track and current on my mortgage and to build up that sense of security I had before this nightmare occurred. It seems to me BOFA wants my home because they have no desire to work with me and start receiving payments. I will not give my home to BOFA without a fight. Once again, here we sit with a December 2nd trustee sale date looming over us and again at a complete loss with seemingly nowhere to turn. Do I pay more of my hard-earned money to high priced attorneys or would Bank of America rather have it

    I hope this helps. For deposit, if you wanted it available immediately, then it has to be cash before the cut-off time. Make sure you ask the teller before you deposit. If it's a check, always keep in mind that check equals 1 business day processing, and would appear next business day at midnight. All branch take deposits on weekend but will process it the coming Monday, (again a business day). Most state cut-off is 2 PM.

    Now, if a draft payment gets rejected, or paid and overdrew your balance, hence charged you an NSF fee of $35.00, as long as you attempted to deposit cash, then Wachovia phone bankers can refund you the fee easily. For any complaints with branch, or inconveniences, report them directly to the 1-800 number. If you are having difficulty with phone bankers, all you need to do is call back and get help. Word of advice, take a breather before you call the 1-800. It works all the time.

    On October 1, 2010, I used the envelop-less ATM to deposit a combination of checks and cash of $898.00. The envelop-less ATM scanned the checks and counted the cash, automatically added the numbers. On November 12, 2010, six weeks later, the Wachovia withdrew $700 as ATM adjustment. They said of the $898.00, only one check of $198.00 was received. I have disputed and it has been two weeks. I have a perfect credit, never bounced a check in my life and been with Central Fidelity/Wachovia for 17 years. I have little confidence that I will get the money back. I switched to Free Checking, removed my funds and keeping a low balance just for the purpose that I may get my money back.

    In Feb 2010, I was contacted by my property manager to contact my insurance because we own 2 properties in El Paso Texas 413, 416. One property is owned by Wells Fargo and one by Bank of America. When I called my insurance company, they stated 413 was not insured for the past 3 yrs to my dismay. I questioned this was impossible; we have escrow accounts on both to pay taxes and insurance. I called WF; they said they have been paying. I then called BofA ;they pretty much kept hanging up and could not give me a straight answer. We finally found out WF had been paying for BofA house and BofA never paid.

    When questioned, their response was we did pay, but checks were returned? How? If I never received a refund overage from my account in 3 yrs if anything it had gone up. In order for me to get any help, I stopped paying for both banks. Well, holly molly, what a mess this has become. I hired an attorney and he filed with the Texas Insurance Commissioner a complaint. Wells Fargo admitted finally, paid my insurance and opened a claim for roof repair; it was a $6700.00 damage.

    Bank of America did nothing; they never could give me an answer I explained to them Wells Fargo paid their insurance and they still had the nerve to charge me $3500.00 to insure the house because the insurance cancelled my policies.

    Meanwhile in July, Bank of America offered a modification. I complied with them and in August, I received a package to respond by 14 of August and send them $1750 with paperwork. When I thought everything was okay, I paid $7100, paid insurance thinking everything was fine. In Sept, I sent my October mod payment another $1750.00 on 9/12, only to find out Bank of America sold the house 9-7-10.

    They sent my tenant a letter to vacate from the attorneys hired by BofA. It was then I found out my house had been sold.I immediately called BofA. Their response was, "oh yes, we do not know how this happened", and transferred my call from place to place.

    I never could get a response. In October, I filed with Commissioner of Texas and have a case number. I also filed with currency of controlling banks with a case number also. Strangely enough, last week my attorney called and said, "Are you sitting or standing?" He told me bank would like to return the house to us. What a ******* joke. My property manager went to check the house for damages, only to find out tenant is still there. Getting someone to make a class action suit is beyond belief with attorneys. No one wants to do anything about it. Money to keep paying attorney is difficult.

    We work all of our lives for what ? Try to be a law abiding citizen and this is how our government has helped by giving money to these banks for what? We are a nation of sadness to see our own country exploited by a corrupt system. What happened to working and being loyal, showing compassion to one another? It is just heartbreaking to work for the American dream. Ha! No more.

    Someone needs to fight. As a nation we, the people, can only make a change by actions. If everyone was to pull their money out of BofA, I bet they would see who really is the consumer making them money. They are a business corporation with no morals or compassion. They do not care about anyone but themselves. God help them.

    For approximately the past six months the Credit Department of the Bank of America has harassed my family at all hours of the day and night with phone calls requesting to speak to Rohnda or Gregory *******. The phone calls have persisted despite my initially advising that neither party were known to my family, resided at my address nor had access to our phone listing. Nevertheless, the phone calls persisted. My request for the names of the various callers met with a disconnect. Subsequent requests to speak to a Supervisor also met with a disconnect. When I attempted to call back the response was a voice mail, which identified the Bank of America as the caller. My irritation, frustration, and resentment regarding this persistent aggravation and abusive intrusion cannot be overstated. I would welcome any assistance from your organization in bringing this intrusive harassment to a halt.

    Case 1: I tried to pay off a cash advance portion of my bill, Bank of America refuse to apply it to the cash advance portions. Their excuse was their policy state they can only apply payments to the principle.

    Case 2: I pay my bills through bill pay. Bank of America raised my bill in the month of October 2010 by $3.00, their excuse was it was a 5 weeks in the month of October, so the interest drove the bill up slightly, they charge me a $49.00 late fee. I called about it on October 18, 2010, The representative waived the 49.00, said next due date just add the $3.00 to the bill. I paid next month and added $10.00 extra. I received my bill, with another $49.00 late fee. I called Bank of America on 11/18/10 at 1:30 pm. I ask what was the late fee for, I was told the late fees was because the minimum payment was not met.

    Bank of America claims the adjustment of $49.00 comes off the principle, but you still have to pay the $49.00 because it's added to your minimum payment. So, my minimum payment have now went up about $97.00 and if you don't pay it, you will go up another $49.00 or more each month.

    I have two bank accounts in Wachovia and I have few online purchases. I pay my bills every month and I want my money returned back to my account. I had been overcharged with overdraft fees of $35 that I find it hard to pay all my bills.

    They put restriction on my business account without my knowledge and branch charged $105 on returned transactions even though the balance was enough to pay those returned transactions. The branch manager refuses to refund this amount. No one in the customer service would have any help so far.

    My auntie has a mortgage with Wachovia, and has been regular and in the habit of paying more than the monthly payment. The loan had always had a 15-day grace period. She, on occasion has made use of this grace period in the past. So, thinking everything was alright, she did so again for this month.

    Immediately, Wells Fargo began to (and continue to ) harass her. It's disgusting. They've done away with her grace period, and they've been calling several times a day (from different phone numbers - surely to circumvent the laws on phone harassment). My auntie's nerves cannot handle this. Every time the phone rings now, she gets nauseous. It has to stop.

    I owned 5 "way to save" checking accounts with Wachovia. After 1 year, I was to receive an additional 5% interest on my accounts. They gave me the interest on one account only claiming that I was not entitled to interest on the other four because Wells Fargo Bank (who recently acquired Wachovia) would not allow 5 accounts.

    The original paperwork does not state this and I was given 5 accounts. I followed the rules to the letter, depositing $100 per month in each account. I followed the rules, now they won't follow those same rules. I lost $240.00 and repeated calls get me nowhere. I do not get calls returned and no one seems to be able to help.

    I made a deposit of $3000 in the form of a business check from a large national research organization, and a 12 day hold was placed on the check for no particular reason that I can gather. When I asked why the hold was placed, I just get a response that: "The decision to place a hold is based on many factors, including the account history and overall customer relationship.

    For example, how long a customer has banked with us, account balance maintained, whether items have caused insufficient funds, and other factors. "None of these seem valid reasons or justifications for placing a hold on a check, if the check is valid and good. Fraud would be the only reason to place a hold on the check, and with modern electronic means it does not take that long to determine the validity. Moreover, I've been a customer of the bank and have made other, even larger, deposits in the past... even from this same source.

    I would consider legal action if they insist on the hold when I contact them Monday, or simply for the inconvenience and trouble they put me to. I would not be surprised if these were discriminatory banking practices designed to selectively optimize their financial position, or arbitrage funds.

    My name is Rene **, I live at **** **** ***** St. Los Angeles CA, 90059. My family and I have been living here for 10 years, and we have had difficulty with our economic situation. My wife and I had our income reduced from our employer causing economic hardship. We started to get behind in our mortgage payment and we have been trying to work with Bank of America for a modification. We have sent all documents requested by the bank and we continue to follow up with them on a weekly basis. On Oct. 21, 2010, I was assigned an underwriter named Zhackreya **. I have been faxing all the documents requested, I have faxed a letter explaining why my wife's maiden name is first and then her married name, and a letter from her employer. I called on 11/13/2010 for a follow up on my modification and again they are requesting a letter of explanation on our marriage status and from the employer of my wife.

    I believe it is improper for the underwriter to be questioning my legal marriage just because my wife has her maiden name first and secondly her married name on our documents and tax return. In our country when a woman get married, she keeps her maiden name and just adds the married name. He also requested we get a letter from my wife's employer showing starting date, wages, frequency of pay, and how many hour she works. We have provided the pay stub for my wife's employer as well.

    I believe it doesn't make any sense that they continue to request these documents, it only prolongs the modification and we are in danger of being foreclosed on our property. We have complied and faxed all documentation needed more than once. We are filing a complaint and requesting an investigation against Bank of America and their underwriters, as they are buying time requesting the same information over and over, and documents with no pertinent information towards the modification, as it is adding to the cause of the high volume of foreclosures. We are asking for your help towards this matter.

    On November 8th, I transferred $425 into my Wachovia Business Account. I had about $2 in there at that time. I then processed a payment to my utility company for $425. The payment went through the following day but lo and behold, on the next business day, Wachovia charged my account $44.28 in fees. There was no notice, no indication what the fee breakdown was. Even worse, the fees overdrew my account when the other transaction processed. Although the bank has now refunded $35 dollars, I am still, in my opinion, owed $35 and I feel strongly that they should also refund the fees.

    On 11-12-10, I contacted BoA about an overdraft charge from a check that went through on my checking account on 11-09. I had a $247 balance and a check for $244.53 was written on November 5 which left me a $2.47 balance. Also posting that day were a $8.00 debit and a $2.15 debit. There were pending debits in between as well but I was $8.07 overdrawn. On Wednesday, 11-10, I had a credit for $102.00 deposited. I was charged a $35.00 fee for the check not clearing. Online on my statements, it clearly shows the $244.53 check clearing and the other two debts causing the overdraft totaling $8.07.

    The banks know that now they can't charge a $35 fee for a debit of $2 or $6. They will now process it differently in their system to flag the overdraft when every where you look at online shows something totally different. I talked to different departments today, 11-12, and heard 5 different scenarios about my accounts. I said my credit card was current and 3 were said to be cancelled. I just don't think it's very ethical or legal to be able to play with your system so it triggers fees but on the consumers end of looking online says something totally different. How are we supposed to keep track of what's coming in or out of our accounts if the banks system can just trigger fees in other places?

    I am constantly inundated with overdraft fees as a result of the confusion of using online banking to track my daily balance. The balance is not accurate and gives a balance of funds that aren't actually there. I believe this confusion is intentional in order to collect fees constantly. This bank encourages paperless banking then later says that I should have used a check register to check my balance.

    I got an average of more than $200-$300 a month in fees for at least one year.

    I opened an account for my investment LLC on Oct. 22, 2010 with Bank of America. They closed my account and sent me a letter dated Oct 26. 10 which I received on 11/5/10. I got a check on 11/6/10 with $40 fee deducted from my account balance. I called and demanded the reason for closing the account and was told that I am a risk to their bank. I asked for explanation of the $40 shortage. They said I'd have to pay for their research. I am shocked but okay with the account closure. If they don't want me, I don't want them. But why the $40 fee?

    It is their decision to investigate me, not the other way around. I don't think it's fair for me to pay them for their investigation. It feels like I have been ripped off. I opened a bank account for less than 2 weeks, and all of a sudden they close the account, take $40 from you and tell you that it's okay for them to do it because it's all in the fine prints of the agreement you signed when you opened the account. Why can they charge whatever they want? Do whatever they want? Is this legal robbery or what? And knowing that they can be here today to rob me because, as a taxpayer, I contributed to the bailed out. That really doesn't make sense to me.

    I feel this never should’ve happened, nor should it ever have gone this far. I was embraced by Wachovia and was told I should not have to hire 3rd party. I should’ve never trusted Wachovia and hired a lawyer who could stick up for my rights and this is why:

    How dare Wachovia take over 6 weeks to return my call? I called Wachovia just about every day as of September 7, 2010 in which I got a letter of denial for modification. This letter disclosed for me to call Wachovia if I felt it was wrong. I did exactly what my letter told me to do on that very day, and when I reached customer service, I was told that the Home Preservation was the only one who would be able to assist me. I called HP for that week and every day I did not get a return call. I would call Wachovia Customer Service again letting them know I have yet to get a call. I needed to update my financial and with the first 3 weeks of going through the same run-around and not one call back, I asked for a manager.

    For the next 2 weeks, all he did was take messages to forward to HP, and then when he was exhausted as I was from at this point even going as far to faxing in a complaint to both Home Preservation and Wachovia Customer service explaining that I have tried relentlessly day in and day out, sometimes twice a day and at this point along with the assistance of a manager to still having no results or call back from the appropriate party.

    After several weeks with the neglect of this matter I was now told I had a sale date. I was so upset that nobody has yet called me back. When speaking to the manager letting him know that this is absolutely ridiculous and I felt at this point no excuse for going in circles while now having a sale date, the manager gave me a fax number and stated he was just as helpless as I was due to the fact that they to have to count on home preservation to take my call and assist me. Therefore, the fax number to the office of the president would be the appropriate one to address this to. I had to fax twice and still it was not until October 27, 2010 did someone finally call me to address the situation.

    I explained this Christine Ship that even during the time that I was waiting upon this office to call. I had made every effort to make contact with her and Home Preservation. The nerve of her to try to explain that now that there is a sale date. On November 9, 2010, it was too late for her to help me at this time. It is not my fault of how long it took for someone to call me back. Then sorry that I never should have been sent to Home Preservation. I was also advised that on that very first call that I made on approximately September 7, 2010, Customer Service are the ones who should have taken my call and made sure I had updated my financial information that would allow me to be reviewed again and would never have had this sale date.

    I could not believe that due to the notes and documentation I have as well as a phone report to confirm I was doing exactly what I was supposed to do. However, Wachovia dropped the ball on making sure I was taken care of or directed as I should’ve to begin with and to have managers point out what should have been done 6 weeks ago, and not stop the sale date to allow me the right for modification. I feel I am being wrongfully denied and Wachovia is not taking credibility for this mistake and how dare them wait so long to call me back and then say now it is too late! I have a sale date due to their neglect. I turned to them due to the decline in my income, I was in an accident and suffered a spinal injury that left me disabled.

    I write this letter with a very heart, but it is yet a letter I must write. Be assure that I get no pleasure from this, but rather I hope that unlike your predecessor, you will find it in your heart to do the right thing in this very special case. In January of 2006, a woman by the name of Marianna ** sold her home in the city of Brockton, Massachusetts. She was represented by a real estate agent and the closing was held at the offices of a licensed attorney. What she did not know was that these men were not honest and that this was a scam to defraud her. The closing was held late on a Friday. Marianna was told that because the deed could not be recorded until the following Monday, the attorney was giving her check in the amount of $69,000.00 to the real estate agent to hold until he could record the deed.

    At this point, I call to your attention that Marianna ** could not read or write the English language. As a matter of fact, there should have been a court certified translator at the closing, there was none. Reluctantly, she was coerced into this agreement. Again, I call to your attention that the check made out to Marianna ** was not endorsed. The real estate agent took the check to Bank of America, signed the check himself, deposited the check into his account. Later, he want back to Bank of America, withdrew the funds and transferred the money to Webster Bank. From there, the money disappears. This was all the money Marianna and her four children had in the world. With no funds and with a language barrier, there was little Marianna could do. Bank of America did not want to hear about this. As a result, Marianna and her four children became homeless. They were evicted by their new landlord. They ended up living out of her car, which was later repossessed.

    In 2008, this matter came to my attention. I immediately contacted the bank. In addition, I contacted Congressman Barney Frank of the house banking committee. Upon consensus of opinion, a law professor took up her cause on a contingency basis since the woman and her children hardly have enough to eat. We assumed that Bank of America would do all it could to help us in settling this matter and clear its good name. Well, that has not been the case. The firm representing the bank has been arrogant and insolent.

    They have repeatedly tried to dictate terms and they have done all they can to delay this matter from being put before a judge and jury. Needless to say, all they are doing is to delay. They do not have the power to stop the case. In the process, however, they will amass a much greater fee for themselves and do further damage to the name of the bank. I cannot believe that this would be in concert with your wishes. I think this is really the image your bank wants to portray to the American people.

    I am not an attorney nor do I profess to be one, but even as such, I would not want to walk into a federal court and face a federal jury and represent Bank of America after pulling such stunts. I believe that an employee or employees of the bank did a favor for a client of the bank. They cashed a check that they should not have. The check did not belong to the real estate agent and it had not been endorsed over to him. He was cashing someone else's check. A check for a large amount of money. The best thing was that the bank would admit that it had made a mistake and do all in its power to rectify the error. That would have been the honest thing to do. That was not done. As of this date, your attorneys are still up to their tricks. They use delaying tactics one after another.

    As you prepare to hand out bonuses totaling hundreds of millions of dollars to your staff, I call to your attention Marianna **. She has trouble paying her rent. She has had her electricity turned off more than once for non-payment, along with her telephone and her heat. She lives in Rhode Island and works in Massachusetts. She has no car. Every morning, she has to walk 3.7 miles to be picked up and taken to work. She has to do this no matter how bad the weather outside is. She has to do this 5 days a week. The woman has suffered enough. I ask you to call your attorneys and tell them that this matter will be settled this month and it will be done so without fail. I ask you to tell them not to attempt to further defraud her. After all, what is the price of the bank's good name?

    Before they settle on an amount, let me ask you this: How much is your bonus? What makes you better than Marianna **? I ask you this last question. How much will a jury of her peers award her in this climate, in this era of bank hating? Are you sure that an appeals court will lower the award or for that matter, even hear the case? How much more damage is your bank willing to take? With all due respect, I thank you for your consideration in this matter and your immediate response.

    Wachovia started foreclosure on my home, but only because they did not post my payments properly. They said I was 3 months behind, when I was actually current. They sent my checks back, when I made my next payment. Now, the house is up for sale, and they will not provide my attorney, or myself, a payoff. I have just lost the sale because of their delays. I never got the proceeds from the sale of the property. They use unfair application of foreclosure fees and legal fees.

    There is an automated call to my phone number several times a week. I have no loan, no mortgage, no business with them. When you try to call, there is an automated machine so you cannot get to a person without an access number. Since I have no loan, I have no access number. This is an annoyance and keeps happening. They say on the message that this is not a sales call. They don't say what it is. I wrote to Van Nuys Ca on September 23. I am still getting calls.

    I needed a letter of credit for a bond insurance company to issue a bond for a company I owned in NV in 2009 and was told I needed to put up a $10,000 CD for the credit. I sold the business in January and notified the insurance company of the sale and that I no longer needed the bond. I told the bank manager of the sale and bond in order to close my CD and they said it was fine. Today, they drained my accounts because the insurance company said they deserved the money.

    To add a little **, they charged me a $400 commission to do it. Now I'm fighting the insurance company for the $ and will never work with B of A again. They were rude and unprofessional with no answers this entire time.

    My daughter was an account holder at Bank of America. She has been out of school (college graduate) for over one year now and her biggest financial dilemma was dealing with this bank's unscrupulous and underhanded business practices. Although I was extremely hesitant to do so and the fact that my daughter is strongly independent, I regrettably finally paid off her balance (she is paying me back monthly at zero interest rate) and she closed her accounts with BAC (cheers!) on 11/01/10. The main reason I took this path after my daughter asked for help is because she was under so much stress worrying about her ever increasing debt.

    Several years ago, Jill started an account with Bank of America at a zero rate interest, only seeing it grow to 19.24%. She never got any help from Bank of America and never realized she could get into so much trouble in such a quick period of time. She had no idea that the rate and penalties would stack up like they did and still no help from BOA. Her bank offered no help and conditions continued to grow worse.

    By the time she asked for help from me, her account balance grew to over $5,000.00. I know that doesn't seem like much to your bank, but to a young college graduate in a very tough economy, it's all the money in the world. She was trying to make minimum payments and had to sacrifice her eating habits. She was beginning to lose sleep at night and this situation affected her health. Can’t they see what their bait and switch, loan sharking business practices are doing to these young people? My daughter is a good example. She finally gave up living on her own for now and is back home and asking for help and I'm glad she did.

    I truly believe that what they did to my daughter is criminal. Although she didn’t completely understand (I pity the less educated people they must attack) what was happening on her account and the reason it was getting hit with constant penalties (the penalties made her account go over the positive balance which then caused even more penalties) and high interest rates. Her minimum payments kept going up even though she was trying to bring this under control at several points. Again, she asked for help from their bank representatives, but they probably were laughing as she walked out the door, saying another patsy.

    When we finally get to a point where the lesson learned was far over, I called BOA to negotiate a payoff amount and talked to a manager (I have names, but I will not mention them as I believe their managers are only pawns in BOA’s corporate practices to lure people into trouble), but to absolutely no avail. Even though BOA took more money from my daughter than she actually got loaned out to her, no one wanted to give her any consideration at all with a small discount to say thank you for paying off your bill, not even $50.00, pathetic. (I was attempting to teach my daughter about the strength of negotiating, but she was so disillusioned with BOA that she just wanted to get far away from anything at all to do with their bank and I do not blame her).

    So in the end, we are not looking to get any compensation from BOA, so please do not offer any at this time, we are well beyond that point. What I do want BOA to know is that we are not going to lie down and take this, we will fight a good battle and initiate a strong campaign to tell the world about the lousy and uncaring bank practices of BOA. We have already begun this campaign and I hope it affects their business very negatively. Yes, 99.9% of the people they unjustly steal from will do nothing about it, but they messed with the wrong customers this time.

    Charged my account 12.99 since December, 2008, when I opened account Privacy Assist, a service that protects my identity from theft. I never authorized this service.

    I am a struggling full-time student with a low-paying job. I have no assets to protect so why would I want this service? There is no way online to cancel this service. I tried this week when I realized I was being charged for this. I strongly think my phone call today won't be enough to stop them from charging me.

    I am not the only one, I just realized going through this as I checked the web and there are many posts of this nonsense, in fact, even came across a class-action suit in another state. I wish I had more time to fight this.

    In 2008, my debit/checks were stolen from my home and used to get money orders which were deposited into my account. I was unaware of what was going on until I went to the bank one day to cash a check and my account was frozen. When I called the bank to find out why, I was told by a woman named Norma G. to go into a branch and withdraw funds in the amount of $1500 and close the account.

    I then told her that the money did not belong to me and I was unsure of what was going on. She then said, "Didn't I talk with you yesterday?" And I replied, "No, this is my first time calling." At that time, I noticed that my debit/check card was missing and I went to the branch and informed them of the matter. We then completed the forms to have the account closed but Norma would not allow for me to open another account which the branch worker and I did not understand why.

    Afterwards instead of the account being closed, it remained open for an additional three months with the $1500 still frozen in the account. My tax rebate was deposited into the account within that time period and I had to get an approval from them just to be able to get it out of the account. When everything was finally over and done with, they closed the account and kept the $1500 that had been frozen in the account. The whole time throughout that time, I received statements still being sent to me as if my account was still in good open standings.

    I had no problem with them keeping the $1500 because I knew that it technically did not belong to me but I still really do not feel that it was right for them to keep it either. Earlier this year when I was enrolling in school, I decided to open a student account with them and was told that I could not and their reason being according to them is because my account was closed due to depositing checks into a closed account. I have worked for a bank and I know it is not possible to do such a thing.

    When I asked to speak with someone, I was given the runaround and multiple different stories. I do not understand how I went through all the correct steps to report my property stolen and I still have the affidavit till this day that was mailed to me after reporting my stuff stolen but they are trying to say I committed fraud on my account. I was told that money was withdrawn out of an ATM and they knew the branch and everything but not once did they ask me to come in and see if I could identify the person on the tape or let alone even look at the tape themselves.

    I am unable to get a regular account now because of the bad mark they have put on my name and what makes the situation worse is it's not even anything I can try and resolve because they took $1500. I never received any money; they did not even send me my five dollars back that was originally in the account and they even took money out of the account for checks that were ordered before the ordeal took place. So how is it that the account was closed but they managed to do that and the box of checks were even mailed to me?

    I would like to take legal matters on this because I'm sure that is the only way this can be resolved. I feel like what happened with my account was not just the work of the one who stole my property but I believe a worker of Wachovia was involved as well because I do not understand how this could go the way it did . Even the woman I dealt with in the branch did not understand what they were doing. If it was something I had done, I would not even bother writing this. I would just simply pay what is owed but I owe nothing. I took nothing and still they have my name all messed up. I can't even get an account. It's hard to want to do the right thing when you have people *** you over in such ways. I am just at a loss for words with this situation and it's a real good way to turn a good person bad.

    My husband worked for a restaurant, so he makes money every night. We deposit the money to the bank next as we needed. Wachovia was changing to Wells Fargo, from Thursday I was having issues, and I couldn't go to the online account. It was giving me error massage, then when I get in there after few mins, it was shutting down. So I wasn't able to see what check is coming and what I have in my bill pay account.

    I apologize that I am not that smart to calculate in my head for everything. I had $1235.36 in my account; my total bill should go about $1204.13. They held the check some reason. They bunched my checks of $35.00, $25.00, $100.00 and $100.00, then they charged me 4 times overdrawn fee. Now they have become Wells Fargo and I did not do the schedule they are paying the creditor from my account. Please help me out. We work very hard for little money; they are trying to make money out of our pockets.

    10/28/2010, received a letter from Wachovia, saying that I didn't request them to stop payment on debit due to no funds and loss of hours.They say, they couldn't do it. She cancelled all drawings on card from other companies but was still happening. Now in debt. Contacted your office, you forwarded to BBB in N. Carolina with case no.**. Since then, they have called three times demanding payment bon this bill, 10/19/2010,10/22/2010,10/27/2010. Keep telling them at time can't pay due to lack of hours, no money.

    They want 70% first week then balance on the second week. No way can do. If they had gone by there overdraft protection plan I have, this wouldn't have happened to me. What's wrong here? Then get a letter from them today denying that I put in for a stop on card. Wrong. I stopped all withdrawals so this would stop. Still got an excessive bill from them plus a credit bureau also wanting there money.

    They could stop it when they wanted to. Why not for me when requested? They say no file on request in records. Good business practice. No help from anyone. They say, I have to pay. They weren't happy to hear I contacted you on said matter. Now, have a closed account due to them. I feel this is discrimination to me. Well, thanks. Feel I can't get nowhere on said matter.

    I have a small 12-month IRA that matured on October 15. I had 7 days, not business days, weekdays, to contribute to it or make any other changes to it. On October 20, I called the IRA department to make a contribution. The number on the maturity notice was useless. I told Andrea, who was cordial and helpful and I have no complaint against, that I wanted to transfer $2000.00 from my checking account at the same bank into my IRA.

    She said she would take care of it and asked if I had any questions, which I did and she answered to my satisfaction. I did this same sort of contribution last year and all went well, the transfer showed up right away when I checked it on line. On the 20th this year, I got very busy and never got on line to see if the change had occurred. The next day when I looked at my accounts, the $2000 had been taken out of checking, but not put in my IRA. I immediately called to find out where my money was. Andrea, again, told me they had a system failure and it would take 7 to 10 business days to get the money where it was supposed to go. I have checked every day since and it is still not in my IRA.

    I live 40 miles from the nearest town. Our DSL out here is almost as slow as our dial-up. Often it all goes down all together. It never takes more than a few hours to get back online. I realize great huge corporations have their problems with large numbers of customers, but come on! Where is my $2000?! 'm an ill, 55-year-old woman with absolutely no prospects. My entire life savings are in that bank, under $17,000.00 (well it would be that if that $2000 would materialize). I have a long way to go before Social Security, and don't have much hope of ever seeing that. I'm frightened and Bank of America is adding substantially to that fright. It's been keeping me awake at night.

    I had an account with Bank of America in California. I am now in Oklahoma.

    In 2007, my employer bounced my final pay check. They were doing illegal activities. I was the Chief Accounting Officer and said I was going to be a whistle blower. I was threatened and left California driving by myself across the country. In New Mexico, a man posing as a cop pulled me over with a spotlight. I tried to get away from him when I realized he was not a cop. We got into a high speed chase. The real cops got involved. He got away and I was arrested.

    I was in jail from 10/28/2007 until 10/5/2009 without a trial. During this time, many charges were put against my checking account. I was not aware this was going on. They allowed my account to run up a total balance overdraft of $599.21. I had a person with a power of attorney and she was never able to get information from the bank.

    It wasn't until almost 2010 when I became aware my account had been overdrafted by many charges I did not authorize.I have been very ill and unable to deal with these things. I had tried to talk to Bank of America when I found it out in late 2009 or early 2010 but they would not help me. Now they have taken a charge for $110.00 from my current bank account. I called Jason at Recovery Services in Bank of America at 877-***-**** or 804-***-**** and he said it is just too bad. I told him again those were not valid charges and he said they would not do anything about it.

    I begged him to allow me to make small monthly payments. I am currently working through the AARP program for people over 55 part time and searching for a full time job. I make about $500 a month. I cannot get my medicine now or put gas in my car. They drained all the money from my account. I was in danger of my car insurance bouncing and a friend who is unemployed gave me $100 I must return immediately.

    After I spoke to Jason and explained the situation, he just said too bad and they would take all my money and it was my problem. After I hung up he put another amount through of $93.71. This took the money my friend loaned me that I must return. This is what he did to me after I begged for mercy and a small payment plan and for someone to look at these bogus charges.

    "Too bad", I am told repeatedly. I am now without even gas money to drive to work or to pay for my medicine and doctor visit I need so badly. Please help me. I am staying with a friend but they are out of work also. I have no one to help me. Please help me get part of this back and get payment arrangements for the part I actually owe. If it is too late for them to fix this fraud, then why is it not also too late for them to take money from me I do not owe?

    My account has an erroneous charge. BofA is very lax about this issue shuffled me off to a claims dept. I called and it would not let me into system with out a claim number. Round and round I went trying to find somebody to look into this charge on my card. Third attempt, they wanted address, birthdate, how many accounts, birthdate of other person on account and date of last statement.

    Long story short, they said I failed 2 questions due to I did not have last statement with me and I got year wrong of ex-husband and I was locked out of system. I called back to be in touch with a supervisor and was told when I asked who I could report BofA to. Mr Armand said he supposed I could call Better Business Bureau.

    In September, 2010, my bank statements informed me that the service charges on my tiered Prima accounts would increase to $25.00 per month beginning in November 2010. Since I am almost 91 years old, in a wheelchair, on a fixed income (half the poverty level), I decided to close my account with Bank of America. On October 5, 2010, my son, Tom **, drove me to Mt. Shasta from Weed.

    At the bank I was referred to Kathleen to process the transaction. She reconciled my check register with her computer data and 'ticked off' the cleared checks, one of which (#3087) was my space rent payment for $320.36 and was deducted from my account balance. This was a mistake, which she later acknowledged over the phone. The check had not been submitted at that time and therefore no funds had been disbursed.

    Therefore the funds were still in Bank of America. The check was submitted after October and Bank of America sent me an overdraft notice. I called Kathleen and asked for an explanation. She said that the mistake was hers but that I had to pay another $320.36 anyway. Two other checks (total $78.55) had not cleared, so she told me to leave $100.00 in the account until they cleared and the balance ($21.45) would be refunded to me. That has not happened either. What recourse do I have, if any? Thank you.

    This week I noticed a small "way to save" transfer of $1, and then another for $2 debiting my already stressed out checking account. I never signed up for this and e-mailed asking them to stop it and to refund the money. They claim my name is not on the savings account so they cannot give me my funds back. I put my husband on the phone with them Saturday and he said that he never agreed to the account and to close it and stop the "way to save". Today, I noticed the funds were not yet refunded. I wrote another nasty e-mail (their response to the last one was to tell me how to close my account.) And then I called them. They said that all I needed to do was to have my husband call them. I told them he spoke with them Saturday. What do they want?

    After keeping me on hold for 10 minutes to speak to a supervisor, the same person came back on the phone telling me that the supervisor would not speak to me because the account is not in my name! I told my husband to march in there in person and get this straight. What is wrong with these people? I want them sued. You cannot believe the fees for unavailable funds I have paid with them prior to the new check law and they are rude, incompetent crooks. The only reason I have stayed is that I have a lot of things tied to this account and I do not like hassles. Besides, I suspect most banks are equally bad. As an aside, once I was overdrawn between paychecks (which always happens) due to their fees mostly, and they took the funds from my son's account without permission rather than wait 3 days for my paycheck. He closed his account so ha-ha to them.

    I called the customer service of Wachovia at least 3 times to clarify the usage of checks from a prior acquisition of another bank – Southtrust. I was told the checks were fine and could be used with no problems. The checks were not and my daughter’s rent check was declined electronically causing a late fee of $114.73. Of course, Wachovia was not liable and would not accept any responsibility for these fees.

    All began with me making a payment for the home equity loan. Wells Fargo hit the wrong button and put in that I paid in full for $80,749.31. That left me with no money for an entire weekend. My husband just got paid, I couldn't buy food or medicine for my daughter who just came out of the hospital. When I tried to fix the situation, they were defensive saying that PNC, my personnel bank, was at fault and their hands were tied to fix the problem. Then the money was credited to me.

    So I found myself $80,739.31 richer. I immediately called my bank to dispute this transaction. They did take the money back, but they took $500.00 more, $81,249.31. When I called Ann at Wells Fargo, she said that PNC didn't return the money and that she knew nothing of my $500.00. She said it was the payment I first tried to make. She made no attempt to help me get my money back. All she referred to is that my bank PNC was at fault and they didn't know anything about it. I explained to her that I live from check to check and I needed that money to pay my bills and food money. She had no sympathy or no customer service skills.

    My husband got an executive from PNC to talk to Ann and we had a three way conversation and she was accusing, again, my bank of not giving them back the money. In return, my bank representative tried to explain that there would be no check from PNC and that this was all done electronically, but they kept putting us on hold to research the problem. It's been 3 weeks of pulling my hair out trying to get my money back. Today, they sent me a check for $114.50, 385.50 short of the amount I am due. When I called to see where the rest of the money was, they told me that they took the interest from the principle and that it would take another 7 to 10 business days to receive the rest.

    I have had to borrow and beg to make it through the first two weeks that this began then, when my husband received his next check. I was short of $66.00, which I didn't need extra expense. I have a bill that I couldn't pay on time and they have put me more of a hole. Physically, I am drained frustrated and angry and very short of money.

    On October 14, 2010, my credit line was reduced to below the balance. On October 20, it was reported to Experian that I am over my credit limit affecting my credit score (I am informed by my credit monitoring service). When I wanted to bring it to Bank of America's attention that I have not been informed, I am told that there is a letter in the mail to inform me, which may take up to 8 days to receive. Now, if it takes 8 days for you to inform me, then how is it that it takes only 6 days to report it to credit agencies? See something unreasonable here? How am I supposed to get the chance to make a payment to bring the account below the limit? I didn’t use this card above its limit, and now my credit report says I did.

    Bank of America continually charges non sufficient check charges so they maximize their profit. I was overdrawn and Bank of America cleared the large amount check first and sticks you with over drafts charges on all the small checks that follow, rather than clearing the small checks first and then the large amount last so you don't incur so many NSF fees. The other thing they've done is hit me with overdraft fees because they have place a hold on checks we have deposited. This is in excess of 1-3 days, in some case over a week. I complained to bank of America and now they place me with their problem account division and have ask me to go elsewhere with my banking. After 20 years with the bank I am appalled at the way they treat their loyal customers. I do not think this is fair business practices and I think an attorney would have a ball with a class action suit against them. I'm sure many other customers are being treated the same way.

    We have been customers of Bank Of America for years and are senior citizens. My social security check is automatically deposited into the bank. We never have our checking account balance below $1500 and have savings with $6000 in the bank. We have never been late or overdrawn on any account and pay our credit card in full each month.

    We opened their advantage checking account with the knowledge that if you put you SS check in and do not go below $1500 in checking it is free. They are now charging us a $15.00 monthly fee for what for the last ten years has been free. The very rude manager will not negotiate this fee and in fact said to keep it free we must put $5000 into checking.

    This action after the American tax payer bailed them out to the tune of 45 billion dollars. That is there thank you to all of us who have been their customers. Too big to fail, well, I say let the failure begin one customer at a time. We have left and I will urge everybody I know to also leave. We as a community of good citizens can bury this bank. Stop all banking with Bank of America now!

    I was doing the loan with her and I'm not qualified to refine because of my income. Gertrude ** told me just to make up a second job and she (Gertrude **) will have her people to verify and approve for me. She told me that is how I will get approved for my refine.

    I feel that Gertrude ** is a Fraud to do loan. And, after I told her that I'm not comfortable to do make up my second job, she didn't even call me back. I feel that if she keeps doing the business this way, eventually it will corrupt everything. We need to stop this business.

    I spoke with Sharon on Oct 7th in regards to making a payment on my account to be drafted on the 16th of Oct. She drafted the funds on the 7th which hit my bank on the 8th and created an overdraft. My bank returned the funds on the 12th of Oct. and again they put it through on the 14th. I have spoken to several different rep from Bank of America and faxed all the documents they told me to fax. They told me it takes 24-48 hours to complete the research and to call back on the 19th. I have called and held now for 2 hours and still have not got this resolved.

    They owe me 2 NSF fees plus a $20.00 payment by phone fee. I had 2 bills due on the 11th. I could not pay because of the overdraft fee. Again, I get someone that knows nothing about my account. Bank of America should be ashamed of themselves. This is complete BS, and I want my money refunded. I went to Bank of America of Sat the 16th of Oct and made a payment on my account. I stand good for my payment to them, why is it appropriate for them to not hold good when they make an error?

    We have closed 4 accounts over the past 12 months with this bank (savings, business, checking accounts). They are the most arrogant, snotty and rude customer service reps I've ever experienced. They will not answer their (local) phone, they just let it ring until an automated system picks up. One day after phoning 11 times (this is no lie), throughout the morning & afternoon, I actually faxed them a huge note and asked anyone, someone to call me. At the very end of the day, someone finally called me. He said "Oh, we were too busy to answer the phone".

    They just don't give a ***! Almost every single transaction with this bank led to some issue, problem or ridiculous request. It's like they do it on purpose just because this bank truly hates people. We kept large reserve balances in all of our accounts but still had to deal with *** (!) on a daily basis. It was never a money issue, just their process of doing business. I have way too many examples to list here of their scheming & deceitful practices. This bank has no rules.

    Why are the feds ignoring all the complaints against this bank?

    I was co-signer for a student loan on behalf of my niece. I was told when I co-sign that if I paid on the interest for a total of 50 monthly payments of 100.00 dollars, that I could submit a request to be removed as an co-signer. I started making payments 17 Aug 2006 to current. I submitted my request to be removed on 20 September 2010. I made it clear that I, the co-signer, is submitting the request. I was sent forms via by email to fill out and to send to student borrower to fill out their part and then fax it to Bank of America. I fax the forms to Bank of America on 20 September 2010. I was told that it takes within 7-14 days to get a response back via mail. I never received a response, so I called Bank of America on 18 October 2010 to inquire about my request.

    I talked to the supervisor of customer service, Mr. Anthony **. I asked him why was my request denied and he stated that my niece had delinquent accounts and the request was denied on those basis. I then ask why didn't I received something by mail informing me of the decision. He stated that the information was sent to my niece. I stated that since I am the one who initiated the request, that they should have sent me a letter also.

    I called to ask about a balance transfer and they said that I could do it. I told them I would as soon as I got home and so they reduced my credit line before I could get home and put it through. I have no problems with my credit history and with paying my bills. They stated they just didn't feel comfortable with me having that credit limit and taking on more debt.

    Overdraft fees! I made a check deposit at a BOA ATM on 10/8/2010. I later learned that the bank had only given a partial credit to my account and the remainder would be credited later. It was because of this withholding of funds that my account went into overdraft. The bank reps stated that "sometimes" the bank will only credit a partial of the deposit "until the funds can be verified".

    I have deposited many checks into a BOA ATM before without any of the funds being withheld. Some of those deposits were personal checks from individuals who used banks other than Bank of America. This particular deposit made on 10/8/2010; it was a check from a large financial institution (World Finance)!

    I was told by the telephone rep that it was only because I used the BOA ATM and this deposit was partially withheld. Result: inability to make purchases because of non-credit and fees.

    I did an electronic payment to my account for my electric bill. I made 3 deposits on Friday, Oct. 8th. All deposits were cash. I got a balance before I left the bank. According to the teller, the electronic payment had not come through and that there was enough to cover the bill. I made another deposit via ATM, also in cash. The message on the ATM machines says that the deposit hits the account immediately. I went into the bank on Monday, the 11th, and the teller says that my electric bill was not paid. I ask why and she says because the money was probably deposited after 3 pm on Friday, the 8th, and would not be available until the 13th.

    I explained to her that I got a balance from the bank and that there was enough money to cover the bill, so why wasn't it paid? I also asked why wouldn't the money be available until the 13th. First of all, it was a cash deposit and cash is always available immediately. Secondly, why so long when the bank was open on the 11th? She stated that even though the bank was open on the 11th it's not really open cause it's a holiday.

    This is not the first time I have had problems with this bank and I have not had the account that long. The way to save account also throws people in the negative because you don't know how much money is being transferred from your checking account. I called customer service today to try and get this straightened out but they were so rude and unwilling to even try to help that I just tried to get in contact with the corporate office but they would not even give me that information. So now my electricity may be shut off because of this foolishness. This bank is ripping people off and someone needs to stop them from ripping off the consumer.

    This is a horrible bank. I closed all but one of my accounts yesterday, and the only reason I didn't close the last one was because they wanted to charge me a $25 fee, go figure.

    My wife who is 7 1/2 months pregnant, and hypoglycemic works for the San Antonio branch. Last week they pulled her chair, and won't allow her to sit down forcing her to get a doctor's note saying she needed it. When she took the note in, they still said it was an accommodation, and not medically necesssary, even though the medical note said it was. My wife could probably get in trouble for me writing this, but seeing as I'm her husband, and I'm writing this, if she gets one word said to her about it, it's just another thing for our lawyer to look at. This isn't all we have to complain about, and I'll be happy to share anything else with anyone who asks.

    At the end of 1993, I started into foreclosure. By March 1994, I paid Wachovia and their attorneys (Shapiro & Fishman) what was owed and reinstated mortgage. Attorneys sent a motion to close to clerks office. They never went to court to close the case. Now it is 2010 and I just had to go before judge for case management and he finally closed case, over 6 years later.

    9/29. I completed online process to open business account. 9/30. I deposited a client's check, which had my company name but not my own, into my personal business account (my only mistake) with intent of transferring those funds into my business account within the next two days. Machine gave me a balance and the ability to withdraw funds, which I did.

    10/1. I went through the drive-through of my branch to deposit paycheck. I was told I needed to come inside. My account had been closed. I spoke with a branch rep who was trying to contact a risk management professional to determine what happened. Bank rep could not get through. I called the number myself on my cell phone and reached a person at risk management who said suspicious activity had taken place on my personal account. The only thing the risk management employee could tell me is that I had made a deposit into my personal account with a check that did not have my name on it, withdrew the fund and used my debit card.

    I told risk management that when I made the deposit the ATM indicated I had a certain amount of funds available, which I used. She then said she had more clients to deal with and hung up on me. The branch manager seemed somewhat mortified and not sure what to do.

    10/2-10/4. No word from BofA. No explanations, no phone calls—nothing. 10/5. I received a letter from the bank with a copy of the original check along with a letter indicating that I could cash the paper check anywhere. I went to two different banks. No one would cash a paper check and thought it was very strange that a bank would think anyone could cash such a check. To date, I have a $5,200 copy of the original check and no way to resolve this issue.

    The only feasible way at this point for me to resolve this is to contact my client and ask him to stop payment on the check he gave to me and reissue a new one; however, I do not know what to say to him. I had promised creditors certain funds by 10/1 and now I am behind and have failed to honor my obligations. I am stressed, distracted and depressed over how to rectify this situation and to get real answers and explanations as to what happened.

    I had just moved here and needed to open up an account to have funds transferred. The female at the desk had me complete an application. Upon doing so, I was directed to "Herrera" who didn't even greet me, but said "your social security number is not correct. " Excuse me, that is what I have been provided. They refused to open up a bank account but there were 7 that is seven Mexicans speaking Spanish who were greeted gleefully by the same downer I had. All provided not a DL or Passport but a Mexican Metricular Card as ID.

    It would be funny if you knew you could purchase as many as you had the cash and could complete them with any name or address you could think of but it is not. Now Bank of America is stopping all foreclosures for the same who are not even whom they say they are and are not even USA citizens and not the taxpayers. Stop the double standards creating chaos and anarchy in the USA. Rights vs responsible citizens.

    In Feb 2010, someone used a fake debit card with my Health Savings Account number to charge several hundred dollars to my HSA account. I didn't find out until March that BOA had put a hold on the account and I could not use it. These charges were in another state, were obviously not for health related expenses, were obviously not made by me (car wash, tattoo parlor, cheap jewelry store, etc. ) and were all on the same day.

    8 months later, BOA is refusing to return my money or even respond to my repeated requests for a resolution. They are still charging me $5.00 a month maintenance fee. These arrogant, bankrupt thieves are refusing to return my money per the terms on the debit card even after they admitted that all these charges are fraudulent and refunded all the charges (6 months after the fact) except the largest one.

    They owe me about $260 more and are refusing to do anything. I am trying to file a criminal complaint but that is an even worse nightmare. I have all the proof but now they won't even show the details of transactions on HSA accounts and are hoping no one notices so they can continue to steal from sick people.

    Because I had cancer and was sick for about two years, I have had income problems and contacted BOA to ask about reducing the interest on my loan according to President Obama's plan. I never asked for anything but information. Yet, the next month, I received a bill from BOA for over $8,000 and they wanted to pay for my insurance and taxes which I pay myself, have always paid myself and have never been late on either or even on my loan payments, never been late. I am due this reduction and BOA owes me money from the date the law went into effect. I should have and should have had this reduction. I am now in remission and after chemotherapy, able to work again, but in need of help financially.

    On 10/8/10 at 11:15 am, I deposited $2600.00 cash into the Bank of America ATM located at 2154 MacArthur Boulevard., Oakland, CA 94602 and was given the response from the machine that it could not process all of the bills deposited. The next response from the machine was that it could not return the bills to me. The ATM then asked if I would like to continue with the transaction, having no other recourse I did continue the transaction. The ATM then prompted me to enter the amount of my deposit, which I did. Then the ATM asked if I would like to complete the deposit, which I did and requested a receipt with a summary. Upon receiving the receipt which showed I had deposited $300, not $2600, I immediately entered the branch and notified the first employee I saw that the ATM had just made an error with my deposit and I needed it resolved.

    I was told that I would have to talk with their Customer Service specialist or that I could call the 800 number on my receipt to file a claim (more on this in a moment) As an aside, I would like to note that what has just happened to me is theft! I had money taken from me by a banking institution without an accurate record of the deposit that I had made and I cannot get my money back. Now the cash that I had is not available to use to pay bills, transfer to other accounts, etc. Furthermore, the temporary credit I was assured by customer service that I will receive in my account within 24 hours is just that, temporary. If for some reason the bank makes another mistake and cannot account for the money that I deposited into the ATM, they will reverse the temporary credit from my account. Thus leaving me without $2300 of the original $2600 that I started with this morning and having to take legal action to recover my money, an exercise in futility to be sure!

    I sat down with the customer service person at the branch and told her what had happened. She was very nice and informed me that she would have to call someone to start a claim meaning she would call the 800 number for me and I had just waited to talk to her for nothing more to be reassured that they would resolve the situation. (At this point I am now the bad guy in this situation, the bank has my money and they need to prove that they made a mistake before I can have my money back temporary credit or not). Seriously, how is this any different than me having been mugged and having to file a police report in order to right the wrong that has happened to me? So we complete the claim process with both of us talking to the customer service person on the phone. I would like to say that the claim process was handled very well and I was given lots of reassurance that if the ATM had made an error, I had nothing to worry about (insert sarcasm). Nice, but it is not the same as me getting my missing $2300 dollars back.

    It seems that Bank of America does not actually operate their ATM, that is a function contracted to another company (I have not confirmed this yet, but is what I have glossed from talking to several Bank of America employees today). Therefore, they cannot just open up the ATM and get me back my money, which I could identify by the various markings, stamps and little notes written on several of the bills that I had noticed while I was counting and facing all of the bills in preparing to make the deposit. So after the shock of having had my money taken from me by my bank and being ground down by several phone conversations with customer service and talking to the branch manager of the branch where I opened my accounts and whom I know personally, I am left to wait for the bank to do its investigation and trust that nothing else will go wrong and that this dispute will resolve in my favor.

    This is hardly comforting considering that such a big mistake seems to happen frequently enough that it seemed commonplace to all of the people I talked to at Bank of America and that they have such a well scripted response for dealing with this type of problem. I also recognize that it is possible that the bank has encountered problems with scammers and counterfeiters trying to swindle the bank by using the cash deposit method to launder money. But the issue is that I worked hard for that money and have done nothing illegal and I am not the one who did anything wrong. Furthermore, I was cordial, friendly and even a bit lighthearted about the situation with everyone that I dealt with (despite my inner rage that had been held up and fleeced for $2300 dollars of cold hard cash!) so that I could get the best service and most calm and concise answers to my questions.

    This is an epic fail by the banking industry as a whole, in this case Bank of America, but it could have easily been with any other bank. And myself as well, I now realize that despite many such deposits of cash and checks into ATMs that I really should not trust the machines that make our lives so called more convenient. The technology is by no means fool proof and the resolution of such issues leaves a person feeling helpless, vulnerable and totally incapable of affecting the outcome. How many others have had similar situations? How often does the bank end up taking the high road and making it right for the honest, hard working customer that has entrusted them with their money? What consumer advocacy groups handle situations like this? How do I get back my day of lost wages dealing with this issue? How do I get back the feeling of confidence and being in control of my own money, and still operate within the confines of today’s semi-cashless society?

    I realize that the answers to these questions are rhetorical in this instance and that life does not always work out the way we plan for it. But if the questions aren’t ever asked, how will we as a people grow into a better society? I will not take it lying down, I will stand up and make my voice heard, I will bring along those that feel the same as me and demand a better way for us all. Do the same and together we will have an impact and make the world a better place. If nothing else, we will feel better about ourselves for standing up for what we believe!

    If your bank sucks, let them know! If your bank is not working for you, take your money elsewhere! It is a pain to deal with but how else will they be motivated to change? In my instance, the time I spent dealing with this would have been about equal to closing all of my accounts and walking across the street to open new accounts at another bank. Once the issue is resolved I can assure you I will be looking for a new financial institution to handle my cash assets!

    The company Southern Salvage, that we worked for, sold on Sept. 24. Our check were about to be pulled out of our accounts because Southern Salvage didn't have enough money in their account. They took care of the problem. But what I am so ** about is when they let us go, everyone took their checks to Bank of America. Because it was in check form we were worried they might not have enough money in the account by the time it went through our banks and you people had the gall to charge us $6.00 dollars a piece to cash them. One girl's check was $97.00 and you ** charged her $6.00 and that was her last check. I have stopped and told 25 people about this and I might stop at 500. Don't you think it's a joke. But until the end of time, I will stop total strangers on the street and tell my story.

I don’t' even associate with him, nor do I have his last name anymore. How did they get my name and number? Then they contacted my brother who lives in Florida! On his cell phone! How did they get that number? There’s no damage. I’m just wondering how they got my information. I feel violated.

    I went to question why I was charged with 3 overdraft charges in one day for being overdrawn. I was sent an email alert saying that I have 5 business days before the next over draft would go into effect. This was on 09/27/2010. I was getting cash funding from the state and was being terminated after October. I went to deposit $40.00 into my checking account to cover for the $10.92 and if there was any remainder left I had $20.00 left of the cash funds I have received. I nearly fell over when I saw my receipt for the deposit. It stated that I was still $80.00 something in the negative.

    On the 1st of this month, I went in to talk to them about this issue. I was told because of past issues with overdrafts (a hotel double swiping my card and T-Mobile taking money for a bill before the agreed dates), they put my account $280.00 something in the red. That made me move all of what was in checking to savings to protect the money I had in there. Meanwhile, the hotel charge and T-Mobile was still rolling over in my checking.

    I was told that they can remove 1 of 3 overdraft charges but will have to talk to a manager to see about removing the rest. I understand one overdraft charge, but in their email I had until the 4th of October before the next charge would take effect. Here is a copy of the email with what was paid out and the charges along with statement saying I have 5 business days to cover. My issue is if I was overdrawn, why was the other purchases allowed to go through?

    Accounts overdrawn for 5 consecutive business days are subject to an Extended Overdrawn Balance Charge. This charge is in addition to overdraft item fees which continue to apply. To prevent this Extended Overdrawn Balance Charge, deposit or transfer available funds to bring your account balance positive within 5 business days from the date your account was originally overdrawn.

    I put in what I thought would handle what was over drawn (deposited $40.00). Now I am left with no money for the next 3 months. My partner wants to put money in my account at the end of each month until I can get my funding back after January 2011. Now she fears that with all the overdraft charges as before when I moved, all checking funds to savings will be eaten up by the overdraft fees.     Since my initial complaint with regards to Bank of America and the vehicle that my husband had purchased through this company, I have received a letter from DCM, a collection agency handling deceased clients' loans for Bank of America telling me that they were going to prorate his estate for the balance of $20,000.00. He had no estate, and there was no will.

    He has since received a letter from Bank of America dated September 27, 2010 informing him that the van had been sold for $12,300.00 and the balance he owed is now $8,312.80. They stated that if a deficiency is indicated, he is to contact Bank of America immediately to arrange payment of the deficiency balance. To receive additional information about this transaction, he is to call or write to Bank of America.

    My husband passed away on June 15, 2010. They were notified of this by receipt of a death certificate. There are no phones nor mail service where my husband is now. It seems inappropriate to write letters such as these to a man who is dead, particularly since these letters come from the Deceased Unit of Bank of America. This is more like harassment.

    The bank put a five day hold on my payroll check. I deposited my payroll check into my checking account on Friday, 01/10/2010. The payroll check cleared City National Bank on Monday, October 4, 2010 but BofA put a five day hold on the check. Both banks are local banks here in LA, twenty blocks away from each other. Will someone please explain to me how is that possible and legal that a bank would not release my funds for five days even after the check cleared the bank that issued it? Will you please explain that to me?

    I have an open checking account and savings a collection agency put a freeze on my account. When I went to cash my paycheck and make a deposit the teller did not inform me of the freeze on my account. So when I when to get some money out of my account 2 days later I was unable to. The teller I believe was racist or bigoted in some way. I have spoken not others that have had freezes on their account and they have been informed by their bank when making transactions. I am a white male. The teller was a black female.

    I was overdrawn two times in a week and I thought I had protection, but since there was a problem with hotel double swiping my card and creating an overdraft 10 months ago and T-Mobile taking money from my checking account before their agreed dates, my account has been up and down ever since. I had part of that cleared up but it still cost me over $350 in daily overdraft charges. I get email warning and they state I have five business days before anymore charges will follow.

    Now just at the beginning of the month (I am homeless and my business is an IT consultant, which has been for the most part outsourced to overseas phone techs), I am not receiving anymore funding from the State of California for the next three months and used what I could to bring my balance up but as I do that, I am hit with another $35. Now from -42.92 I am now looking at -125.92.

    The bank says there is nothing they can do. I need the account as my family in New Zealand send me what they can afford at the end of the month to my account so I could survive until I can find work and get help again from the State.

    My husband and I and our kids went to the branch on Saturday, 10/2/10 about 11:45 a.m. He wanted to cash a check $5899 that was sent to him from Innovatrade. (His mom passed away and that was money from an investment that she had and was sent to him after the will was read.) We waited in line and Jennifer attended him. He handed her the check and his CT issued ID and she asks if he has an account and he says no, so she responds that he needs another form of ID so he shows his Bank of America Debit Card.

    She plays with the check back and forth, very load and rudely asks him where did he get the check, if he got it on the mail or offer (from that moment her demeanor changed, we were treated as criminals), then she shows the amount of the check to her co-worker on the right and on the left, they started whispering and rolling eyes at us, completely unprofessional.

    About 30 minutes later, she comes back stating that she could not cash the check because there are some issues with the check, she could contact no one at the bank that made the check, didn't have required lines, different fonts and is issued to Daniel ** and his ID says Daniel **. We explained that in Puerto Rico, we used dad and mom last names but when we moved to CT 10 years ago to prevent confusion, he only uses his one last name and that he can bring his social security card and birth certificate to prove it.

    She asks us if she could keep the check and she will contact the check issuer on Monday, 10/4/10, to verify the check. She asks for the best phone number, I wrote my number in a piece of paper and that she calls me with information. Today, 10/4/10 at 9:32 a.m., she calls me stating that she couldn't get in contact with the check issuer and the manager said that they would not cash the check because the check is no good.

    She did not call nobody, they did not want to cash that check. Wachovia Bank in Miami tried to call them but no success. This is a racist issue. I called the manager Lisa **, Daniel already gave them permission to talk to me, to ask about what was wrong with the check, now they don't want to talk to me because I'm not Daniel, but they talked to me earlier. What is wrong with them?

    The bank called them to verify and now they say they won't cash it, period. We want to see if we have a case due to racism and privacy issue. Please let us know. Thanks in advance.

    As a follow-up to my earlier complaint, I called BOA again this morning only to find out the "appeal" that was supposed to be done within 7-10 days and has not happened yet, was declined. I also found out today that FHA loans cannot be appealed. After speaking with Laquesha, she said she was going to try and reach Mr. **'s extension, to which I replied, it won't work. She came back and said "you're right, it doesn't". She then transferred me to a supervisor Telvnia in home retention, who proceeded to tell me that the mysterious Mr. ** left me a message on July 23rd. She insisted he did call and I swore to her that no one called and left any message.

    She made my modification null and void because my paperwork have not come in on time. I proceeded to advise her that yes in fact I sent it on time, with a tracking # as proof of delivery, which I gave her. I also faxed it all on July 23 to Project Hope. Again on hold, she came back saying I didn't make any payments since March, wrong again. I had my cashier's check dated 6/2/10 for the amount required, a check for July and called in my payments for August and September. She went in to check and confirmed I did make the payments. She said she would contact the elusive Mr. ** again and see if he could reopen the modification, but wasn't a guarantee because he makes the decision. Telvnia updated my financials on the phone and told me Mr. ** has 48-72 hours to get back to her with an answer and she would call me back. She did, however to give me her number with an extension to reach her for me to follow-up as usual.

    The problem with all of this is my letter of intent to accelerate expires tomorrow 10/2/10 and still I have no remedy. It seems that all my paperwork is in order, but BOA has a problem with logging in or delivering the paperwork in a timely manner to negotiators, which has put me in this foreclosure possibility. It seems that I have complied with all of BOA's requests in a timely manner, usually before the time required for it to be in. There is a possibility of foreclosure. I have been under doctor's care for emotional stress because of BOA. They have destroyed my credit and if because of this I have to leave my home, I don't think I will be able to find somewhere else because of the credit. I'm very distraught over this entire process and I'm at my wits end for a resolution. I would like to find a very good attorney and sue BOA for emotional distress and punitive damages for their disorganization and bad business practices.

    The bank put a hold on the funds in my son's savings account for 10 days, from September 20th through the 30th. It was supposed to be available September 30th. I went into the branch to take out the money and close the account and the hold was still not take off from the account. Are they legally allowed to place holds on people's accounts?

    I was asked by the upper management to take a demotion, and when I refused, I was fired. Wachovia is a horrible place to work in. The upper management is very discriminating, hostile, and mentally abusive. I am not the only employee that this had happen to. The EEOC need to investigate this company, and their policy. If you are not white, start looking for a new job. I am currently unemployed, lost my car, I could not keep up with my apartment rental, I am late on all my creditors payments, and I am now emotionally out of control.

    I was trying to get home loan modification and was jerked around and lied to for months. I reported Bank of America to the Office of Comptroller of the Currency and was automatically cut off from all normal channels and turned over to the office of the President since I had filed theft charges against NationsBank (now Bank of America) years ago. They gave me Larice ** to handle my account. Don't let her good looks and sweet voice fool you. You will learn like I did with a knife in the back. First she tried sending me a bribe. When I returned it telling her, “No thanks, just do the job that was scheduled 9 months ago,” she accelerated my loan so that they can push me into foreclosure. She knows I can't find employment and refuses to help.

    I fell behind in my house payments when I started having medical issues that required me to be in and out of the hospital, missing work. And as we all know--no work, no pay. After a full month of going between hospitals and doctors, I returned to work and got current on the payments. I have learned that now, I will be having brain surgery (doesn't sound like it is optional, does it?) and will be off work for a minimum of one month, if not two to three. So I did the "right thing" and called to make arrangements for the next couple of payments. I know that there used to be a way to skip the months and apply them to the backside of the mortgage--and apparently, there still is, if you have income! What? I need to skip the payments due to medical loss of income for those two months, but since I don't have an income, I am not eligible to do so.

    Since I won't have income, I will not be eligible for something that could help me continue to keep my credit on track. But I have to make the payments as "late" and each month or 30-day mark can drive it further into the ground. In addition, they will be calling 15 times a day from various numbers they use to try to find out why I am not paying! So I am now planning my recovery from brain surgery, knowing that I may be facing foreclosure by the time I am able to return to work and knowing that I will be receiving their nasty calls the whole time I am trying to recover.

    Bank of America does not want to help with my mortgage problem. In the first place I was not with them, but with Countrywide and I didn't even know I was switched to them. I recently lost my job and collect unemployment. I asked about the Obama program, but they give me the runaround so I will lose my home.

    I just want to add that Bank of America needs to be sued by the American people for all the distress they cause people who try to modify mortgages! They should be ashamed that they carry the name America and they have done so much damage while they bask in the good life. Big bonuses and all the benefit yet the clients they treat like beggars and give nothing back to this land and the president and the attorney general let them get away with it.     Due to a rare disease, I had to take a demotion at work and eventually quit working all together. In January I contact B of A for a home loan modification and in February they sent me the modification agreement to sign and have notarized and sent back to them. I did so along with sending out the first payment on a personal check, as customer service had not told me it had to be certified funds.

    On March 21st, I received the payment check back saying it had to be certified funds instead. So I called to find out where to send the certified funds to and in doing so was sent to four different departments and eventually told that the modification agreement had been declined due to my income showing much higher than I had reported and that a letter had been sent out telling me of the declination. I told the person at that time that first off I never received any letter and secondly, I had no clue where they were getting the income amount from because if I were really making that I never would have had a problem making the payment.

    They proceeded to tell me I needed to start the process all over again. A week later, after having called in everyday and going over my financials five times with different people, the new process finally started but it took until the end of April 2010 to get a number to fax all the documents to again that had been faxed in January. So once again, I started calling every week to follow up on my review. Then during this time, I was told by two different reps that the original modification from March was never declined and to go ahead and send in the payment. So I sent two payments in for more than it required to be put toward the back pay only to find out two weeks later those reps were wrong and never should have had me send any money in.

    I was then told not to send in any payments because they would just send them back to me. I never received those payments back nor did they tell me what they applied to them to. On 9-23-10, I was told by yet another rep they had me in the Attorney General program for the second go around and that they had declined that two months prior in July due to the same income issue I had on the first one, only once again no one ever sent me anything nor did anyone ever call me to ask me about it.

    The income info I faxed them showed my income at $3700 a month while they say I bring home $6200 a month. The rep couldn't tell me why in the last two months of my calling every week to follow up on the review, no one had seen that it had been declined in July. So I called in again and got a different person as always and was told that he would start the process all over again and he agreed that they had been giving me the runaround and it wasn't fair.

    During this, my home has a sale date of 9-29-10 on it and the rep put in a request for postponement for me. I spent the day on the phone today trying to figure out what is going on and was told that they team is still reviewing my stuff and may not okay the postponement. That's because I wasn't actually in a review at this time but just being decided if I could be reviewed for the third time that it probably meant they would go ahead and auction it off.

    I have read many complaints of home owners that are going through or have gone through the exact same thing with Bank of America. During all of this, I repeatedly asked to speak with the negotiator handling my account so I could find out what they were looking at and was never allowed to. I have never been able to speak to anyone but the rep on the phone per them, we are not allowed to talk to their supervisors or anyone else higher up.

    Bank of America has given me the total runaround and I would think and done some very illegal things in the process. Not once did they send me any paperwork stating they declined either program, not once did anyone ever call to verify income, not once did they let me speak to the person actually handling my file nor did I ever get the same person twice.

    Each person had a different story. I even had one rep tell me they had sent me out the second agreement at the beginning of August and never received it only to be told they don't know why I was told that. I also had one rep tell me that he had sent an email to the department to speed up the process and that I would have paperwork within 10 days and never received it and then when I called to find out where it was they told me that I wasn't in that program. I was actually in the AG program and that they never should have emailed the other department for an expedite. Anything you can do to stop B of A from hurting any other person would be much appreciated. I don't think they should be allowed to continue this kind of deceit and trickery on others. Thank you.

    On 09/21/09, I opened a checking account. Later on my credit report, I learned that Bank Of America did a credit inquiry when I opened the account. They did not inform me that they were making an inquiry, thus doing so without my knowledge or consent. I have attempted to no avail to get them to remove it from my credit report (Transunion). I have closed my account over this issue.

    Back on August 6th, 2010, I walked into a local Wachovia branch to make a deposit. The next teller, who happened to walk over from the drive thru section, came up to the window and waved me over. I told him I'm depositing $800 cash into my account. Now, I'm used to them asking me to slide my card in that machine right by the window, but he said he will take care of my deposit at his station by the drive thru. No problem. He comes back and I always ask, when I make cash deposit, is the money available now? He said, "Yes, it is available for withdraw from ATM if you wish." I replied, "Okay, thank you." I leave.

    Now I was planning to go to Tampa, but didn't for the weekend. Good thing I didn't! Because the $800 was not there in my account! I saved the receipt and called Wachovia on Monday to ask why it's not in my account that I did last Friday! They checked and the guy teller made a wrong entry or some nonsense. And sure enough, one charge came during the weekend (One of those that just happen to come when your account is low!) and I got charged $35. But Wachovia admitted the mistake and removed that, and my money was in the account.

    Now here it is on Sept 2010. I went to another branch of Wachovia to make $180 cash deposit on Friday, Sept 24, 2010. This time, the same thing happens, guy from drive thru comes over and takes my info. I didn't think anything of it. He tells me my money is in the account. How again is my money is showing in my account? Even still the receipt says calendar and deposit effective date is 9-24-10. It's now 9-27-10 and still nothing! I call and Wachovia says they will check. Apparently, the teller typed in the wrong account numbers. She was saying something about the number on the card is small or some nonsense.

    How come when I slide the card it goes to my account? But when this guy takes it over to his terminal, he has to type in numbers? So my money went to some other persons account and I do see now that the receipt has the last 4 digits of another account. I never checked before because I never had this much problem! They must have some scam going on for two different branches to always make the mistake on a Friday that you deposit cash for the weekend and you wind up ** and facing overdraft charges, because their tellers aren't doing their jobs.

    Don't make a cash deposit on a Friday. Go to a teller who is sitting at the window, not one that walks over from the drive thru. Check your receipt to see that it's your account number on it because they know you think your money is there for the weekend. They see your account is low when they pull it up, so they can easily make one wrong entry, you get your receipt, you walk away. Bank is now closed for the weekend, and you don't find out until Monday, all the charges you made during the weekend are now all including overdraft fees.

    You know your money was there. The bank doesn't show it was there. Then you got to argue on Monday with them about removing all those fees, when they have a leg to stand on and say, you didn't have the money in the account!

    John **, together with Timothy ** (another employee of BofA) and a realtor named Steven ** (Oak Realty, Framingham, MA), formed a conspiracy to violate federal real estate law. The three of them agreed verbally to allow Steven to place a lockbox and a "for sale" sign on a house that was part of my late mother's estate. The Probate Court in MA had not yet named BofA the executors of this estate, even though my mother's will named BofA as executors. BofA had no legal right to enter into any agreement with any realtor until being named executor of this estate.

    The realtor's sign generated a lot of interest in the property. Many people called, trying to see the house. Steven told each caller that the house was "not really for sale yet" and could not be shown, and that he could not give the caller a date to see the house later. We know that at least 12 people called and received this info from Steven. When the court finally named BofA executors, and the house was ready to be shown (months after this scam), a different realtor had the listing. The house got only two bids, which was very surprising given the desirability of the location (Reading, MA).

    We know for a fact that the conspiracy and the subsequent violation of federal real estate law hurt the estate by driving away interested buyers. BofA was supposed to be looking after the interests of the three heirs in this estate; instead, BofA deprived the three heirs of income from the estate.

    We are going to send this complaint to the A.G.'s office in MA. We lost income from the sale. We got only two bids on a very desirable property because other buyers were frightened off after hearing the realtor's highly suspect responses to their questions.

    They took over an already corrupt organization, i.e. Countrywide and continue the wrath of offering subprime/toxic loans to struggling Americans. My personal nightmare is that my loan was with Countrywide and is now with B of A. Countrywide made a feeble attempt at restructuring my loan into another ARM type loan and adding more to my monthly payment. As soon as B of A took over, they wanted to look good by offering me a federally sponsored "Obama sponsored" modification. This was supposed to be a 3 month process where I was to pay a trial period payment structured to what would be an affordable payment for my income (i.e. not more than 31% of my income). This seemed like a reasonable program to help keep me and many, many others stay in their homes and hoping that the economy would improve in the meantime.

    Well, its been 15 months and until my last statement each and every other statement said that I was i on a trial period payment plan and that I was to keep paying that payment. This was also confirmed several times over that next year via phone conversations with B ob A's "call center." Now they say that I did not qualify because of this elusive NPV formula they use to check out one's eligibility? I don't get it. If I've been paying into this loan for 10 years now and want to stay in my home, doesn't that qualify me as a responsible homeowner/mortgage holder? I have a six year old son and am now renting half of my home because I've had an occasional work shortage (I remodel homes). Since I didn't qualify for the modification, B of A has cranked out a couple different "indications" as to what is happening with my loan.

    One has been to send/call me threatening with foreclosure (since now my loan is apparently considered delinquent because of all the money I wasn't paying while on the trial period payment is now due because they didn't approve my modification). The other is that I am now up for a "second review" for an in-house modification and that foreclosure proceedings have not begun. I am determined to stay in this house that I have put everything into. I will stick with this until I get some resolution but I do feel that I'm running out of options and am not comfortable dealing with B of A on my own any longer.

    On Saturday, September 04, I went into the Bank of America Sunrise Branch, to cash a check from my new employer, for $2750.00. The teller informed me, there would be no hold on the check, received manager approval, and cashed it instantly. I was puzzled why there was no hold, because when I first signed up with Bank of America, I was told if I brought in a check over $500.00, there would be a 2-3 hold until the funds were available.

    Since then, what I was told has been true, until now. On Saturday, September 11th, I deposited into the ATM, two checks in the amount of $787.76. On Monday, September 13th, I went into the same branch to withdraw some money from my Checking account, from the checks I deposited on Saturday. These two checks from the County of Sacramento were still on hold. At this time, the teller (Aaron), mentioned my Savings account was overdrawn, due to the check B of A cashed on Sept 3rd, didn't clear. I asked him, "Why the check was cashed into my Savings account?" He was unable to answer the question, although he informed me lately, there has been many checks of this same amount going through the bank, and they are fraudulent checks.

    He recommended that I go to the police which I did, but they were no help. On Thursday or Friday, September 16 or 17th, I went into the branch again, to talk to the manager (Scott) who initially approved the check for cashing. I explained to him my concerns with Bank of America not obliging with the holding policy, I was informed of when I first signed up. He responded, Since I am a good customer, the bank trusts the checks I bring in. This is considerate, although extremely biased, since all checks should be processed the same, especially one, in the amount of $2750.00. He requested reporting the incident to Bank of America fraud department, and provided me the telephone number. When I returned home, I looked at both my accounts online and I had $643.43 in my Checking and -$2,750.00 in my Savings.

    On Tuesday, September 21, I received an email saying my Checking account is overdrawn, by $2170.36. I looked online at my Checking account and the overdrawn amount from my Savings account, had been switched to my Checking account, and cleared the $643.43 from my account. I immediately went into the same branch again, to find out why this occurred, without my permission. Lynsi ** and Christina ** (manager) looked into the history of my Savings account, and said, there is now no record of my Savings account ever being overdrawn, or the check being cashed into my Savings account. I explained to them how unhappy I was as a Bank of America customer, and I notified them I would be pursuing this further. I believe I have been lied to and taken advantage of by Bank of America.

    I find it Bank of Americans fault for: First, cashing the check without a hold, especially since the bank was aware of fraudulent checks, of this same amount going through the bank, (lately), Second, switching the overdrawn amount from my Savings account to my Checking account, leaving me with nothing; and Thirdly, removing (or whatever action was taken) to vanish the history from my Savings account. I have a letter from Bank of America dated September 10th, which in fact states my Savings account is overdrawn, meaning the check was in fact cashed into my Savings account.

    In addition, B of A is trying to justify not putting the $2750 check on hold, but yet, there was a hold on the other two checks totaling $787.67, from the County of Sacramento. I am completely dissatisfied with the ethics of Bank of America, towards me as a Customer, and I want the $643.43 returned to my Checking account, and the bank to take the lose for the $2750.

    Last January or February, I called BAC about obtaining a loan modification. The rep told me I was pre-approved and that during the review process (approx 30 days) I should not make payments. In April I received a document and contract stating that I had been approved for a Home Saver program and if I accepted, to sign the contract and mail it back. The modification was for a repayment plan (of course for the payments they told me not to pay). It was to take the late payments and move them to a separate loan to be paid back starting October. I was to start making my original payments in May. I did everything that was asked.

    I signed and returned documents and resumed my payments as of May. Around August I received a bill that stated I was delinquent on my mortgage. I called and was told not to worry that I had another traditional Modification being offered to me. I received the documents and this modification raised my mortgage by about $450/mo. I called and asked about the original modification and why it wasn't showing up. They said that there was no such contract. I called back a few days and spoke to a rep who found the original contract. She called that dept. and about 1 hour later, I was assured not to worry that the original modification was going to be honored and BAC would credit me late fees and fix my credit.

    They transferred me to the negotiator for the traditional modification. She said she would hold onto the offer until the end of Sept. but said I should go with the original modification. I called numerous more times throughout Sept. to find out the status. Each time I was assured that the contract was valid and going to be honored and that it would be sent off to management to be accelerated. This past weekend I received a notice from an attorney representing Bank of America that they were going to start foreclosure proceedings.

    I called the attorney and she too can see the contract as well as the documentation that I was told that the modification would be honored. We both called BAC and now I am being told that they are not going to honor the contract and they told her to proceed with the foreclosure. I have called the negotiator for the 2nd modification who has said she would hold onto the modification until the end of Sept. beginning of Oct. to ask her to send documents with the new dates. She will not return calls. As of now I am in limbo with BAC and stressed about my home. I am so stressed out that I can't sleep, eat, or deal with my day to day things. I spend every moment I am not at work on the phone trying to work this out. I do not know what else may happen but I may have to pay back an amount that I can't afford or lose my home.

I was told verbally and in writing to allow upwards of 90 days for my financial status to be reviewed due to the volume of modifications currently being processed. And, as a result due to partial payments my credit would be affected. Needless to say, I agree and begun the process. There were preliminary interactions. I provided further documentation, etc. I also called diligently week to week, month to month to actively stay current. What was initially a 90-day process turned into 180 days and ultimately to 13 months.

    I received a letter April 2010 stating I was approved for the modification and permanent documents would be in the mail 7-10 days. These papers never arrived. I have called Bank of America over and over being looped through a barge of departments (Making Home Affordable Dept., Retention Dept., Specialty for Permanent Mod. Dept., Exception Clearing Dept., Direct Advocacy Dept.) again and again to know current or accurate update. Some of the representatives are very pleasant but the system is broken.

    Finally, today after again being looped through several departments, I had a representative tell me my permanent modification as of September 19, 2010, 13 months later, had been denied! First, they said they sent me a letter stating approved and that I should be patient for the final documents. Denied. Now, due to the extended trial payments 13 months, my past due balanced is over $12,000 because again of 13 months versus the 90 days evaluation process.

    Long story short, the way Bank of America handled this modification was atrocious. Institutions such as this live and breathe by an honor system. Lives depend on it. Customers follow through with their commitment and responsibilities in a diligent responsible fashion and are reprimanded when they do not and the Institution should be held to the same standard.

    My recourse now put by the last representative I spoke to was to "short sell" my house or "liquidate" it; in other words, up root and take my kids and family to wherever and leave my home. Remember, I thought the purpose of this modification program was designed to keep families in their home and not uproot due to incompetent processes

    These lenders need to be held accountable and speak openly for their short coming and not portray the lender as always the problem here. I am reaching out to whomever is listening: this did not have to happen this way. I am a hard working American who is not asking for a free ride at all, but to say you can help and then cause more damage is just unequivocally wrong. What can I do?

    On September 16th, I made a cash deposit and on September 18th my cash deposit was still not posted. I went down to the bank and spoke with the rude manager. I explained to her that I no longer wished to bank with Wachovia. The manager then refused to look into the matter any further and told me that I would just have to wait until the money was posted. I went back down to Wachovia on the 21st but my deposit still was not posted. By chance, someone from another location was covering and she spotted the problem immediately. The deposit was made to someone else’s account. When the bank manager came back into the office she smugly said to me, “So did you close out the account?” I told her what happened and she didn't even apologize. I was very disappointed. I am in the process of trying to make a complaint. Which is a process in itself!

    Bank of America closed my refinance loan after 4 months of fight. However, in these 4 months, I ended up in closing the loan with mere frustration and anger. I was promised in GFE that I would be given $4050 as a closing credit. However, I was given only $3837.38 as the closing credit. When I inquired about the situation to BOA home loan customer service, they said I have to talk to loan officer (Cynthia). Cynthia will never respond to her emails or phone calls and she would always be in a classified location with no customer access to her. I have sent multiple emails and made multiple phone calls/voice mail, but never received an answer. I am not given $500 preferred employer credit which they are supposed to give for all the preferred employers. Never work with Bank of America. They are cheaters. I totally lost about close to $1000 and my time spent on the refinance.

    Payment lost in transfer of company, payment to TB&W, cleared account on Aug.11, 2009 and B of A has been harassing ever since. Nothing being done to help me in this situation completely beyond my control and credit is being trashed. Consumers with Bank of America: they say they are not reporting to credit bureau. But guess what? They are! That one missing payment has royally screwed my credit report! Check your report now! Check your credit report asap!

    Contact the federal trade commission and occ! Very helpful! And contact your bank! Find out exactly what account the money was transferred to and if you used a check. Copy front and back! Call your attorney general's office and call B of A as often as possible. Make it known. Also local news stations! Let's get this taken care of! I've been dealing with it as long as you have. It's been over a year!

    Consumers beware! My husband and I contacted BofA for a refinance in May. We fired BofA in July because we could never get answers. They are unresponsive to phone calls, e-mails. Finally in reaching out to their Presidents office we had contact and still no answers.

    We found our loan was in underwriting with still no close date in site. We demanded our application fee returned. Remarkably we did receive. We chose to go with Amegy Bank and we already have a closing date, better rate and a fair market appraisal!

    Listen anyone experiencing these prolonged, strung out problems with BofA, cut your losses and go to a local bank. I wish I would have read the blogs and complaints before we started the process with BofA. Our improvements would be done our bills consolidated without the nightmare and tactics being used. By the way BofA appraisers appraised our home $100k under comps. They are taking 6 months to close. 40 days better terms, real appraisal with home town bank.

    Don't fall into the trap. Even if we had lost the application money to BofA, we saved 10's of thousands of dollars in interest. I will never do business with BofA again. They should have never been bailed out. Businesses go under for a reason and it generally stems from not taking care of business.

    Bank of America and I entered into a modification agreement back in December 2009 and I was to pay trial payments for three months and I completely abided by my agreement and Bank of America did not. If I abided by their agreement then they would modify the mortgage and would correct all reporting to the credit bureaus. Instead, they reported me delinquent four months which affected my credit so bad where all credit card companies raised the interest rates and then caused me to file bankruptcy.

    Now, ten months later, Bank of America is still playing games and still has not modified my mortgage but did admit that they incorrectly reported on my credit and would fix that within 45 days but all the damage is done. I have been screwed by Bank of America and I will be filing a lawsuit against them if something is not done or I will join one of the many class-action lawsuits against them.

    Bank of America has made a real habit and a normal business practice to screw their customers and I am one of many.

    After losing my job and then two months later coming down with cancer, this is not right and I pray that one day the president of the bank can live the hell I have lived the last three years and maybe he can wake up and see how he and his bank has screwed the same American people that bailed them out of bankruptcy. How is this being allowed to go on. I pulled up on the internet and there are over 1000 complaints just this year against Bank of America and nothing is being done except give them more of the taxpayer's money.

    I have been forced in bankruptcy and if something is not done, I will end up losing my home to Bank of America's mismanagement of my account. I am living with severe stress over this and these greedy jerks could not care less. They will answer to a higher authority one day for all of the injustice they have dished out.

    I opened my Wachovia account in May to set up a direct deposit for my school job (which required a Wachovia account). A month ago, I authorized Citibank to withdraw a certain amount of money from my account to pay my credit card bill. Wachovia, claiming to have overdraft protection, failed to move the proper funds from one account to another as advertised, resulting in two overdraft fees ($20 and $35).

    After speaking to customer service three times, a representative told me that it was possible to have my money refunded, but I had not been with the bank long enough for it to be authorized (which in retrospect was probably also a lie). For this reason and the fact that I have encountered their bad customer service before, I promptly closed my account and moved all of my money back to PNC, whose customer service has always been helpful enough to refund any fees charged.

    It must also be noted that the staff of the New Brunswick branch (save a few helpful people), are the most rude bank staff I have encountered. For instance, I had parked in the Wachovia lot which included a drive through teller to do business with the branch. When I left my car, the two tellers in the annex harassed me by telling me my car would be towed if I didn't move it. I reported them to the official branch.

    Also, upon closing my account, I told the banker that I was closing my account because of the customer service and he noted my official reason for closure as "Personal," specifically noting that their service was "OK." Shady business practices with bad service and rude branches. This bank should have failed and closed up shop in our recent recession.

    I have been trying to get a Home loan modification through Bank of America since Aug. 2009. I first started with the "making home affordable" program that Pres. Obama put in place to help keep families in their homes. I qualified for this program, in fact in May 2010 they told me I was approved and my paper work was going to under writing. This would have lowered my payment from $2,687 per month to $ $1,477 per month. Two weeks later, they told me I was denied the modification stating that I did not qualify and could not help me because I was not behind on my payments.

    I filed an appeal and won, (what they call) "A Second Look" program and took me out of the making home affordable program. Even though I qualify for the "Making home affordable" program, they refuse to use this program to help me.

    As of today, I still have not received any help from Bank of America, not even temporarily lowering my payments to what the modification amount would be. I'm getting help from my family to make ends meet. I really need this modification to stay in my home and I feel it's robbery what Bank of America is doing.

    I have a checking account, which had a balance of $350.00. I responded to an ad for a mystery shopping job. The company paid me with a check of $1956.00, which I took to the bank. I took $1500.00 from the check to follow the instruction as per what the company asked me to do with their funds and left the difference at the bank. To my dismay, the check bounced or was a fraudulent one, and because of this, my account was depleted and the bank ran me in an overdraft of $1150.00. My contention is why did they allow this to happen. I did not know that the check had to be left for some days before it clears. I got the money so I thought that all was fine. Then I realized that I could not use my debit card. Then when I called, they told me that the check returned and nowhere can I find the people who gave me the check.

    I am unemployed and has to pay back the $1150.00 and lose my $350.00 that was on the account because Bank of America did not put a hold on the check. When I asked why, they said to me that I am a good customer and that they offer good customer service to their customers (in this case I wish I was a bad customer). I opened an account with Wachovia Bank just to get at the fine print, and it clearly states that an amount equal to the check is held against your account for 5 working days before being cleared. Kudos to Wachovia Bank. People, please do not bank with Bank of America. Once you have an account, they do not protect their clients against scams and fraudulent activities.

    I owed $172. I made a payment of $100, leaving a balance of $72, due by 9/21/20. The first page on the website confirmed the amount due and the date it was owed. However, when I clicked on the link(s) to make the $72 payment today, the web pages showed I still owed $172. To be fair, the 3rd page where I choose the amount to pay did give me an "other" payment option where I could type in $72.00, but people like my husband would have blindly paid what was on the screen, $172 (minimum about due). When I talked to the BA rep, it turns out that the two payment pages are actually linked to the current statement, rather than the first web page which has the up-to-date information. Therefore, people like my husband would have blindly paid the full $172 because that's what the screen states, rather than the actual amount owed of $72.

    It is my belief that this simple programming fix has not been made because this little "mistake in programming" can get Bank of America more money in their pockets earlier than agreed.

    The bank charges $35.00 for extended overdrawn accounts for more that 5 days. It does not make sense two me, two overdraft items were $9.00, so in 6 days, the bank charges me $35.00. This is 5 times just to secure itself for payments of $200.00 made on my behalf. Does that make any sense and any benefit to the clients?

    On May22nd, I started to work with BofA on refinancing my home. After 90 days, I went to Quicken. BofA sent me Spanish only telephone numbers to call them about the issue. I don't speak Spanish, They also starting having their automated system call me daily to collection on accounts that are all current. They say they can't stop it.

    I had to remind them to get the appraisal done and after a period of no contac,t I called to find out the status. They told me they were afraid to call me because they were going to have to lower the line of credit on the home. After I canceled the refinance with them, they sent me a letter denying the refinance as not eligible. Their automated system is hell to navigate. I will never do business with them again. I wrote the feds a letter and copied them. They should go under. They charged me $400 for the abuse.

    Wachovia repeatedly overdrafts my account, when I know that I have sufficient funds. I have my own spreadsheet that I use to track all my transactions separately from my online banking. But even after comparing my spreadsheet to their website, and seeing no differences in transaction amounts, somehow they are showing that my available balance is less than the balance I have! It is always by just a few dollars. But this is all it takes for me to get charged several $35 fees, which add up!

    When I call them about this, of course it's always my fault, not theirs. I am very meticulous about balancing my checkbook and accounting for my many check card transactions. But they still somehow manage to overdraft me! This is very suspicious to me. And I think they count on the fact that most people don't watch their account like hawks, as I do. I have also noticed this suspicious "INTL service fee" of $0.90 that has suddenly started popping up without any warning. What was this fee for? I never got any notice about it! I believe it is just an excuse for them to pilfer money out of my account. Then, if I missed it in my own accounting, they can charge me again with overdraft fees when something else bounces. I am at my wit's end, as I believe this is plain, old-fashioned thievery.

    I used to think Wachovia was the greatest, after my horrible experiences with another huge bank that I won't name here. But I have lost my faith in them since Wells Fargo took over. For those who think I am making a big deal out of $0.90, just remember that they have millions of customers. Multiply that 90 cents by the number of checking account customers, and that is a huge chunk of money (thank you for not publishing my full name).

    Transactions are posted late. It is as if someone chooses the order. They are switched to charge me overdraft fees. I have printed statements from my account online where on 9/13/2010, I had $42.00 on my regular checking account and $50.00 on my savings account. For overdraft protection, that is a total of $92.09 of my money at the bank. I purchased 3 items on Monday night after bank hours (9/13/2010) so $92.09 - ($19.54) = $72.55. On Tuesday, I checked my balances online, and I have $42.09 as my balance posted and available balance of $72.55 available.

    That night, a transaction came for my internet bill - $30.00. Wachovia returned the payment, and is going to charge me "insufficient funds"! Why are they doing that if I have the funds of $72.55?! The manager said that she was going to call me back tomorrow and she took my phone number down. Please help! Wachovia is stealing from hard working people.

    This is about Wachovia and their fee scams. I had direct deposit with Wachovia. Every Tuesday is when my direct deposit happens and every Tuesday we had fee's of crazy amounts mysteriously hitting our account. I'm sure you've heard this from thousands of others! We finally changed banks but it was way to late! We tried to talk to them hundreds of times but they always had excuses! We couldn't pay our bills because they took all or part of my check week after week! We were 3 to four months late on all our bills and I had to pull out thousands of dollars from retirement to pay off all the bills and now our credit is in the tank along with everything else!

    Like I said, we had to use thousands of dollars(10,000) to pay off all the bills that added up plus our credit went in the tank! They shouln't be allowed to get away with this. I know you have heard of these scams because they lost a law suit and ordered to pay 200 million to people they scamed until june 2008 but our situation continued until about 3 months ago!

    Alexis called me, trying to reach my neighbor. When I asked if this was a bill collection, she said, "No, it's a personal call.” Of course, when I called the number back, it's a B of A collection agency. Irregardless of her financial state, B of A has no right to call my home for my neighbor's collections. That is harassment. I told my neighbor's mother that B of A had given me a dubbing call. She is embarrassed and uncomfortable that her neighbors are pulled in her daughter's financial mess. I am uncomfortable being in someone else's mess. There has to be a limit to a company's collection procedures. And the involvement of a neighbor has to be outside the ethical boundaries.

    I have a cleaning franchise with CleanNet USA. CleanNet banks with Wachovia. In order to verify availability of funds and to get my cash quicker, I opened an account with Wachovia. I decided it would be wiser to open another account to pay for subcontractor work. I keep just enough to pay subcontractors in my subcontractor account and the remainder of funds in the second account. My complaint is how BillPay is set up. Recently, I paid bills with the subcontractor account which did not have enough funds to cover my bills in error. This was my fault. What I think is underhanded is that the system allowed me to pay bills with not enough funds in the account so they could get NSF fees from me and I had more than enough money in my other account.

    I wish I could close out these accounts and not do business with Wachovia, but CleanNet does not offer direct deposit. I was refunded $17 of $66 in fees charged and offered the opportunity for overdraft protection, which involves applying for a credit card or opening a savings account. For every charge, $1 would be transferred to savings. This seems like a bookkeeping nightmare waiting to happen. It's another clever way to get fees in the guise of helping the consumer save. BillPay should have a block when there are no funds in the account! I subsequently had BillPay removed from the subcontractor account. I just wanted to let someone know who may have input in getting Wachovia to change this policy. I was charged $66 in NSF fees and reimbursed $17!

    These people begin ripping people off by charging excessive insurance amounts using Balboa after financing the vehicles. I was given a 30 day binder to add vehicle to charge. I had on another vehicle. They denied that and threw in an excessive amount. They claimed I owed. While I was attempting to get that resolved, they repossessed the vehicle and charged an overly excessive amount before releasing it back - all of what they claimed was owed + approx. (fraud) $350 more. After that they attached another $5.00, they claimed was for previous insurance for 2 months (already collected more than amount they claimed owed, in lump sum).

    I pay every month on time and they deduct $5+and charged a late fee from my on-time contractual amount and begin to call numerous times a week asking for more money after they take payment and charge other bogus amounts. They are very rude crooks. They have caused extensive damage to my credit by submitting invalid reports which have caused me denied credit. This, as well as the constant calling and the fact that they have even illegally called my job as well as others I know w/ lies after I asked them to cease. This all has caused a lot of emotional and physical distress.

    I ordered an item on the internet that I did not know was in Canada. BOA charged me $2.66 for a foreign fee even though the funds did not need an exchange done, the amount I was charged the day I ordered it matched my statement. Customer service was contacted several times asking to remove the charge; they continually blamed it on the vendor/PayPal, stating they couldn't help and passed me from agent to agent. Each time I called, eventually got put on hold and the agent never returned to the line so I had to keep calling over and over. I finally was so furious that I closed my account, they didn't seem to care even though I have excellent credit and have given them a lot of business.

    About an hour later, I realized that I didn't redeem my 3,691 points so I called them back. They said it was too late and I can't redeem them. I went to the local branch where I opened the card and talked to a manager. They called customer service, but no one would reverse the charge. As for the points, I guess they "need to think about whether they will let me redeem them or not". Terrible customer service and they really don't care when they lose a good customer who pays on time every month. They could have backed off the charge this one time and let me know if I did business with the same company again and the same thing happened, I would be on my own. Instead, they let me close the account for a disputed amount of $2.66. I realized that this is a very small amount of money, it is the principle. I don't like being take advantage of, ripped off or rudely treated. If they do not redeem my points, I will file a complaint with the Better Business Bureau in their area.

    They closed my account because they said that something came through on Chex systems with my name on it. My pay check was directly deposited to Bank of America, they never notified me of the closure, I had to go without any money for over a week, then they told me that I had to wait 2weeks to a month to wait for my check on the remaining funds in the account. I called a week later and some one from risk management told me that my check would be mailed out on the 7th of September. When I called on the 7th to verify the funds were mailed, someone else told me it would be on the 10th of September. They proceeded to ask me whom I talked to because that information was not correct.

    This wasn't the first time that information from one rep to another was wrong. when I called on the 2nd of September to check my available balance, they said that my account was due to be closed in 5 days and the phone rep said that my account was not yet closed and I could withdraw my money that was available. When I got to the bank, they told me that they could not access my account and I had to call risk management to get them to lift the hold so that they could release my funds. Certainly, they refused and was very rude to me.

    I will never bank with them again. If I get any type of money, they will not get any consideration and I'm also considering legal action

    Someone perpetrated fraudulent activity regarding my checking account. I have been trying to resolve this fiasco since early August 2010. Every time I go to the banking "center", I am told something different. Then the time before, I keep having to speak to many different people who do not give me correct information according to the next person I talk to. I have been waiting to receive $867.00 from my savings and the bank will not return it until the fraud claim is resolved! What a bunch of crap. I have no money and I was told on the 27th of August that I would be receiving a check in the mail and it would be automatically issued on September 2, 2010. Now I'm being told it will be sent to me on Oct. 1, 2010. This is unacceptable. I have been inconvenienced greatly with my time and money!

    I absolutely have no money to help me with my daily living expenses. I live 56 miles from work. If they had not told me I was going to receive the check after the 2nd of September, I would not have paid the bills I did with my residual paycheck. I have spent over $1100 trying to close this account!

    Recently my husband and I decided it was time to close the account at Wachovia. This is the Biggest Money Hungry Banking Institution that care nothing about their customers that I have ever known. My husband and I have lost over the last 8 years countless about of money to them for overdraft fees, unavailable funds, and NSF. This was a institution with Integrity when it was First Union and now its like Taz the cartoon character who eats everything it sees. Wachovia takes everything it can get it hands on.

    I have been with this bank for ages over and over again. I would complain and things would come down only to start up again. They had no intentions of helping my husband and I or caring about our needs, they wanted those fees and by all means possible they would seize them. I remember during one Christmas they hit me with about a $700.00 of overdraft fees. They would take 35.00 for something that cost 3.00. It was absolutely ridiculous. I ended up having the worst Holiday of my life due to this stress. They paid nothing and left us with no money in the bank during the Christmas Holiday. My husband and I changed banks recently Thank God. We just got our money out of there. I sent them a email over the online account stating that I would like one of checking accounts closed, and that there was to be no more activity with the other. If anything came in to sent it back cancelled. I was calling around trying to catch everyone with the change but just in case I did catch them in time, please let them know the account was cancelled. I wanted this to happen because I knew how they were with overdraft fees.

    I also wrote that I wanted to change it into a Saving. So a day or so I checked the account and I was overdraft by $200.00. They were letting everything come through. I wrote and told Wachovia I would pay up to an certain amount and that was all because I had requested the one account closed and other changed into a Saving. They would not it do because of overdraft fees. I have refused to pay it. I recently received a Wachovia recovery letter stating we owe them the amount of $562.00 in overdraft fees. This is a lie and I refuse to pay it. I will pay what I wrote in my letter to them and nothing more. I want to file a complaint against Wachovia. For Countless unnecessary non sufficient funds, overdrafts fees and unavailable funds charges over a period of several years.

    I help to start a business for a friend and sign on to the account. This account was not connected to any of my other accounts. He overdrew the account and did not clear this up and they went into my account and clean it out without any notice. They have my address for the other account they could have alerted me of this account balance before they just took my money. The funds were my paycheck from Kmart and these funds were left to pay my rent and bills this has cause me to put everything in jeopardy of losing and late fees.

    On 8-31-10 around 11:56am I spoke to Lashawn ***n from the Wachovia customer service department. Very rude agent from the beginning. I was calling because I got a NSF of $35 for something that I still don't understand why. I had deposited the money in the account the night before but they state that at the moment of the transaction the money wasn't there.

    I was just hoping to get an logical answer but the agent just kept on getting very hostile. I then told him I didn't want to speak to him anymore and the first thing out of his mouth was that he could have someone contact me in 24 hours. I told him that I needed to speak to someone at that moment so that's when he told me he would transfer me to the Spanish line. I never asked to speak to someone in Spanish. I speak perfect English but since he was able to distinguish my Spanish accent, he automatically assumed. I feel very discriminated towards that action and although I'm proud of being a Latina, I didn't appreciate the way the agent handled it. I then called back and spoke to a very nice lady that provided me with the agent's name as well as filing a customer complaint against the agent. She did tell me that the agent had placed notes in the account stating that the call had been disconnected. How convenient!

    I refinanced my mortgage with Countrywide Homes loans in December 2008, reducing my monthly payment to $1500 monthly and adding 10 years to my original maturity date. Bank of America took over my loan in April 2009, and apparently did not accept the terms I had with Countrywide, as my mortgage was now $1800. Bank of America offered me a loan modification agreement to take my mortgage back down to $1500. I agreed and began the modification process.

    Bank of America requested financial documents from me in October 2009, and again in May 2010. I have complied with and sent in all documents requested and paid the reduced amount for over a year. I am now being told by Bank of America as of August 2010, that I was denied for a loan modification, because they requested additional information in July 2010, that I never received, and that I owe $13,000 for the last seven months.

    I have requested my payment history 3 times, in an effort to get some understanding, as to what they have done to me, to no avail. I have also requested information on how I could possibly owe this amount of money, and where the payments I have made are. Only to be told it has been applied to my account. None of this makes any sense to me.

    I have tried to call on several occasions, to be placed on hold and then disconnected. After calling back, being told BofA is having problems with their phone systems, for over a year! Please, is there someone, somewhere that can assist me in getting this matter cleared and to really deal with the fraudulent practices of Bank of America? Bank of America has sent me a notice to accelerate.

    My husband was out of work so we tried getting modified with BOA through a third party. Well in the meantime, we were told not to make our payments until the modification was approved, well we were denied. So we lost money we did not have, paying for the 3rd party to help us. So I called BOA and asked about the government modification that I kept hearing about. I gave them all the information. They told us to make a lower payment during the modification and not to worry and we will be approved.

    It was supposed to take 3 months so I called on the 3rd month to see if I should make the lower payment. They said yes, because it is taking longer then they thought. Six months later, we got a letter saying we were denied and we owe $3860.00 that was the difference between the lower payment we were making and our mortgage, which went up $200 a month after getting denied the 1st modification. We do not have that kind of money. My husband is back to work but we are still trying to get caught up. Plus we have an equity and they told us the equity would be modified also. Now they are demanding money on that, or they will foreclose.

    They are reporting us with our payments during the modification which no one told us that would happen. They told us our mortgage is frozen.

    We are in a mess and I am trying to get refinances but with a low credit score, it is hard. This is not fair, they got money and they are supposed to help us but instead, we are going to be homeless and no one will help! We can't sleep, I am losing weight and I can't eat. I cry all the time and my husband yells all the time. It is so stressful. It is not fair and I don't know where to turn to.

    Like everyone on this site, I have been swindled by Wachovia but not with the same severity as others. I made a cash deposit on Wednesday 8/25 at 4:40pm in the amount of $300 for a car payment. I then went down the street and wrote a check for $267 the same day at 4:45 for the car payment. Two days later, I checked my online account and found the check bounced for insufficient funds. Now the only reason I opened this account is that my company uses this bank for payroll. Long story short, I got tired of putting my thumb in the ink pad and after being pressured every time I went into the local branch and opened an account 3 months ago.

    Anyway, I called customer service and spoke with Eloise ** and my problem fell on deaf ears but after a length conversation, she implied that this was the way banks earn revenue and it's a very big business. Boy, was she right. After researching this on the web, it's a mutlti billion dollar scam played on all unsuspecting bank customers. I could have just let this incident go because the check came back the next day and was paid minus the $35. But I was frustrated and went to my local branch at 9:00 am when they opened and spoke with Charles. He listened to the issues and said I was out of luck, there is nothing he could do since deposits are not credited until the next day because the cut off is 2:00 pm.

    But my question is, if that's the case, why are debits allowed any time? The same rule doesn't apply. This seems extremely unfair and for anyone reading this article, do your homework and check the complaint sites. I have 3 different banks and all but this one have been very good and all without incident. I then wrote a check and pulled all my funds, went back to Charles and closed my account. Now my story isn't as severe as most others, but says volumes about how dishonest, decitful and deceptive Wacovia Bank is. By the way, they are now runned by Wells Fargo! In the end, I was smart enough to see the writing on the wall. Are you? Do your homework, and check the complaint sites first.

    Bank of America electronically withdrew from my checking account $400.00 without my authorization. After repeated phone calls requesting the money be put back into my account, Bank of America has still not yet returned the $400.00. This has been ongoing for since August 9, 2010, 17 days as of this writing. Bank of America initially told me it would take no more than five days to return the money to my checking account.

    Today, after yet another phone call to them, Bank of America informed me that it will be another 7 days before they could make the $400.00 credit into my checking account. Bank of America was able to withdraw the $400.00 in a matter of hours but somehow it takes over two weeks to return it.

    Meanwhile, I've had to live off of $1.92. Not eating much and Bank of America knows this.

    I received a message to call Wachovia via my email regarding a secure message. After asking me my full Social Security Number, my account information, and my address, when I opened the account(s), what type of services I received, Alex ** refused to tell me why I received this secure message. I just had an interbody lumbar fusion and cannot walk. This person was the supervisor. He still refused to give me information. I asked him if I needed to call the police. He refused to comment.

    I cannot walk, nor can I sit up for more than two hours at a time. He told me I had to go into a Wachovia Center to find out. What? And he was extremely rude. He told me my account information was inaccurate, which it is not. I have paid over $24,000.00 back in my auto loan. I am not late on this month's payment. I am concerned and guess I have to call the police. Meanwhile, I answered every question correctly and called the number they requested. How am I supposed to go walk into a store? And why wasn't I provided with the information? I have no idea how this will effect me, as I am disabled. It is outrageous how these banks gambled with mortgages outside the country putting the entire world in a tailspin causing massive layoffs and foreclosures. Why doesn't Obama do something about this rabid actions of the banks? It's their fault the economy is like this in the first place.

    Everyone complains about past administrations, but what has this administration done about the banks? Nothing! I am so sorry I voted fro Obama. Maybe Sarah Palin doesn't know her geography, but she knew enough to return the money to the people of Alaska and to throw the corrupt people out of government.

    I forgot my pin number so I went to Bank of America on 8/25/10 to change my pin number. The manager claimed that he can't do it for me. He told me to call the 1-800 numbers on the back of the card. So I did, the costumer service on the phone told me they should change the pin number for me. FYI: To anyone banking at Donald Lynch Boulevard, Marlborough, MA 01752, do not ask the tall (manager) to help you. He is a **. They need to get rid of him because this was not the first time I have dealt with him. This man always gives me a hard time. The others worker, they treat me like a customer.

    My husband purchased a van through Bank of America in April, 2007. Payments were automatically made through his Pen Air account. My husband passed away June 15, 2010. Bank of America's Deceased Unit was notified via phone by me that he had passed away. They were sent a copy of his death certificate. At that time, I informed the person I talked to I did not know if I would be able to keep the van as the payments were probably going to be more than I could afford and I did not know how much income I would have. A payment was withdrawn from his account on July 5, 2010.

    I closed the account due to there not being sufficient funds in the account to pay August's payment which would have been withdrawn on August 5, 2010. I received a call on August 6, 2010 asking what I intended to do. I told the gentleman I was going to turn the car over to the nearest Bank of America facility the following week. This was done the following Tuesday, August 10, 2010 in Destin, Florida. I called Bank of America to verify that they knew about the turn-over and was told they had been notified.

    I have tried to work with this company all that I can under the circumstances. I was informed by them they did not make any modifications to loans and would not work with me in any way. I made the comment "You would just as soon lose an account"? The response I got was "We can sell it at auction." Since that time, there has been a letter come addressed to my husband and stating he broke his promise. This letter comes from the Deceased Unit which one would think would show more compassion for the family than to send a nasty letter to a man who is no longer around. It was as though he had broken his promise because he had the audacity to die. No regard for the grieving family in any way. This company cares nothing about their customers and makes it clear. Other people have also formed their opinions as to how cold and uncaring this company is toward their customers.

    My daughter who is a student opened up her first checking and saving account. The FS Officer offered a benefit to my daughter, saying that he was going to link her savings account to her checking, so in case she was going to overdraft the account on her checking, the money would be taken from her savings. He did not disclose to me that there was going to be a fee charged for doing that.

    For the bank to take money from her savings to deposit into her checking account, the bank was charging her $10 each time, when you could easily do an online transfer which would not cost anything. I contacted Erik several times, and he explained that he couldn't do anything about it and that he had to talk to Jason.

    I have been calling them several times for the past two weeks and have not received a courtesy phone call. Being the consumer, I feel as if they did not perform customer service in trying to resolve this issue. And until today they still have not called me back. There were too many excuses, and I feel that my daughter was taken advantage of, especially she being a student and has no clue of banking.

    No disclosures about the fee was mentioned. The only excuse that they could make was to read the material that was given. Come on. If the FS offered the option which is a choice, he could have taken the time to explain the fee, unless he was thinking about the commission that he was making off on it. I am for the principle, and if this is how the consumer is treated, then I think people out there should really look at their bank statement and see what else they are being charged for.

    The last couple of months, they have been stalling payments. They either take the money right away and it does not show up on your account or the payment sits there saying processing. BOA updates your bill with more interest from new charges after you've already paid then magically, your payment/s will appear after the new charges/interest.

    Sent them a insurance check for property damage from state farm ins co that was made out to myself and Bank of America as first mortgage holder and Chase Bank as 2nd mortgage holder. After completing all necessary paper work and sending Bank of America the endorsed check they deposited the check into Bank of America acct and after 4 weeks they sent me a Bank of America check made out to myself and Chase Bank. Chase Bank won't endorse the check because they already have endorsed the check. I went to Bank of America and they tell me there's nothing they can do. Now I have a check from Bank of America for $4810.30 that I can't cash. What can I do? Bank of America has the money in their account which is not theirs bearing interest and I can't get the moey owed to me.

    Our small business had an account with this bank for many years. On July 16, 2009, embezzlement by our former bookkeeper was first discovered --not by Bank of America and their fraud scanners but by my husband, Robert **. When the bookkeeper disappeared, he needed to pay mounting bills and asked for the statements in person at the branch. The statements showed multiple ATM withdrawals of cash, many made at a local casino! Bob had never used an ATM card for our small business and the employee who is now convicted of her crimes was not even a signer on the checking account! How then could the bank issue her this ATM card? We were never alerted by the bank regarding any unusual activity or change in pattern.

    My husband was consoled by the bank employee that there is fraud protection and that he need not worry. Bank of America would credit the $37,548 for company use during this stressful time. That was a promise unfulfilled. On July 17th more was discovered to have been stolen, by unauthorized means of bank-to-bank transfers, bringing the total to more than $160,000 from this account since January of 2008. This bookkeeper, with Bank of Americas cooperation, was able to set herself up as a vendor and money was sent directly to her personal account. Even since this discovery, Bank of America has charged us thousands of dollars for overdrafts and NSF fees!

    As might be imagined there are also many ancillary expenses caused by this crime. Our company had been with Bank of America for more than twenty years, yet when we inquired as to how the bank issued the bookkeeper an ATM card and password without our permission or knowledge, we (as well as the local police) were denied that information. Nevertheless in a letter dated Aug. 13, 2009 from Bank of America, the postscript states we are entitled to such documentation. We received the same run-around regarding the fraudulent electronic payments made to the bookkeeper using the bank account. Subsequent discussions with a CPA and an attorney both informed us that anything regarding this business account should be information available to the owner of the account, by law. However, promises from Bank of America remain unfulfilled!

    Some individual or individuals at the bank is/are responsible for allowing this theft to occur. Not long ago, Discover Card contacted us on our cell phone because of a change in our spending pattern. This was just after our $50 purchase of gas in Arizona! This type of security technology has been successfully used for decades in financial institutions. How can a bank as large and as well known as Bank of America perform any less with our many thousands of hard-earned dollars?

    As time goes by, our debt has increased particularly because of a Bank of America line of credit to cover overdrafts that turned into an extremely high interest loan. Even after months of paying down this debt, Bank of America was not willing to modify the horrendous interest rate, knowing full well our predicament and its causes.

    In March, Bank of America issued a check for $11,140. However, no explanation for the small amount was given. When my husband asked for something in writing, the request was ignored! After a prolonged wait for a better response from the bank, we have closed our long standing account and found a bank with a better reputation in the area. Though the former bookkeeper was convicted and is in prison, this does not resolve the problem of Bank of America's gross negligence in handling our business funds and we are hopeful that with pressure, they will do the right thing.

    Two withdrawals were deducted from my personal bank account from Bank of America for the same amount at different times; only one was supposed to be taken, I asked them why they would make this mistake. They told me that they don't see the 1st payment made so they take out the total amount due on the due date. This is a crime, I had zero balance and the card was paid in full at the time of deduction. I asked for my money back and cancelled my card; they are making me wait at least 10 business days for my money back. This is $164.17 that I need to pay my bills with that they took from me without me knowing. Please do something about this, thank you.

    I was a customer of Wachovia bank for some time until they started to take from my bank account almost every week. I got paid every week and I would go to the bank to cash my check. And before I could get my money, they would take out for some unknown fees. I would get overdrafts even if I had the money in my account. I got so tired of it that I decided the next time that they did it, I would not pay it. With the last 3 transactions, I have copies of the receipts and the purchases that were made, and the amount of money that was left in my account when I made the purchases.

    The purchases were made at different times at different stores. What they did was hold the transaction from going through and put them through all at the same time. This caused me to have a $35.00 overdraft on all (3) of the transactions. There would have been money to cover all the transactions if they had allowed them to go through when the purchases were made. That happened on 06/30/2008. After that, I decided no more, and I wasn't going to pay it no matter what they said or did. They didn't want to work it out, but they wanted me to pay them. I said, “This was it. Close the account or do what you have to do, but I won’t be paying this. Report it to the credit bureau. I don't care.” I still have the proof right now in my purse. I don't know what made me hold on to this stuff, but I did in a way I'm glad I did.

    Because I happen to have a lot of money, I move it around frequently, electronically to other banks. I made a lot of electronic transfers during the month. BoA shut down my account on Friday, 8/13, and never told me this was done. I transferred money to another bank, only to have them call me and say the check "bounced". I said that wasn't possible, there was over $8,000 in my checking account. A phone call to BoA and they said I've had too many transfers (even though there was money) and they closed my account. They never notified me, never did a thing and of course, I had no way to know it was closed. When I called them, they said "they are the bank and can close an account at any time without reason or cause and do not have to notify you".

    What total arrogance. I did nothing wrong, but actually moved money around and they now won't refund my money until they close the account in 15 days.

    I recently noticed a $15/month fee for a "business suite" on my statements. The charge was hidden in a section outside of the normal checking transactions that I do review. The charge has existed for 16 months. Yes, I should have noticed earlier, but it was not in the regular transactions section that I do review monthly. Bank of America acknowledged that they made a mistake by charging the fee in the first place, but refused to refund my money. They said it's their policy to only refund 60 day's worth, regardless of whether it's their mistake.

    I applied for a refinance through World Savings in 2005 and have come to realize that it is a "Predatory" loan, a COSI with prepayment penalties. What can I do now that I am losing my home? I have been unemployed for almost 2 years, I am 58 years old. I have well over 1000 resumes out in email and I am losing my home of 11 years. I am stressed and depressed having nowhere to go once my house is sold, if that is possible. I am in debt and before, I had over an 800 credit score. It is now not even 600. So with destroyed credit and no help from Wells Fargo or the OCC or Hamp or any other company/organization I have tried reaching out too.

    I guess I will be living in a tent across the street from 1600 Pennsylvania Ave.! An acquaintance suggested I try and find people out there like me who have been taken advantage of and are now losing everything due to the greed of our politicians, the banks and our own president. Please help us! I am a natural born American citizen who cannot even get help in her own country. Shame on our government, shame on Mr. Obama.

    One check over drafted for $80. There was $53 in the account. I was assessed $35 overdraft fee. However, they took 3 other pending charges made on the debit card (the money had already been taken from the account when these charges were made). They manipulated these 3 charges so that when the charge is finalized, there is no money in the account bc of the 1 overdraft. So that is 4 $35 fees. It didn't stop there. They then manipulated those $35 feels to be deducted from my account when there was money in there.

    So now, they took 2 different pending charges (once again when these charges were made, there was money in there) But because they are rearranged the $35 fees to appear when there was money, the pending charges appear to have been made when there was no money. So that was 2 more $35 fees for a total of 6 $35 fees bc of 1 overdraft. It is obviously a scam. All they tell me is they can't change it. $210 deducted from my account bc of 1 overdraft. Please advice.

    First off, I wish I had found this website before I ever banked with BOA. Bank of America has made mistakes on my accounts in the past costing me time and money to rectify. Last mistake was my federal tax check. I deposited it via ATM at my local branch in Roslindale, MA. Bank of America decided all of the sudden my name was not on the account, and that they would withdraw almost $10,000 without so much as a phone call or email informing me, then proceeded to send it to the wrong address and have a 10k check floating around for 1-2weeks via US mail. This caused a great amount of stress, bills to be late, having to borrow money to make my rent and almost cancelling my wife's trip to El Salvador to see her sick mother. I have been a customer since 1996, the name has changed 2-3 times if I remember correctly and I have a very good record with them as far as my finances go. This happened between May-June 2010.

    Fast forward to August, my daughter's 5th birthday, in the mist of planning a party and a very busy week me and my wife overdraw our account, completely my fault, I do not deny this. The total overdraft was $200, there were 4 purchases total, one was a large one and 3 smaller ones. BOA charge me $35 four times, plus 2 $10 for overdraft protection totaling $160. Now I go from -200 to -360 because of charges. I thought calling BOA and talking to a supervisor and showing them how they had made such a serious error on May-June and me being understanding not asking for interest on my 10k check, or compensation for the time I spent calling them, the post office while I was trying to track down a ten thousand dollar check they sent to a wrong address, plus my past record and being a customer for almost 14 years would help relieve some of the overdraft fee's, nope, not one.

    BOA can make as many errors as they want on your account with no repercussions, I asked to dispute it but instead when my next direct deposit went in they took $360 not giving me the chance to even pay it off over time, I am still playing catch up with bills because of this, times are tough. What happened to due process? This bank would be under water without our bailout funds and this is how they treat a 14 year customer?

    I have used BOA online bill paying for years without problems. When paying bills this month, I needed to add another payee. When I entered the information and hit ‘add, all of the amounts that I had entered for the other payee’s disappeared. I re-entered the amounts and hit ‘pay’. Warnings appeared that several of the payments could not be made because dual payments for the same amount were made on the same date. I waited 24 hours and checked to see if there were pending transactions on my checking account. There were none. I then called the BOA 800 number and could get only an automated voice. The status of my account was that I had the original amount and that there were no pending transactions on my account. I then reentered the amounts and paid my bills as normal.

    Within 2 days, I started to receive emails from BOA that my account was overdrawn. I went to the local bank to get my account corrected. I was told that the $240 in fees will be removed and they would need a few days to make the corrections. Three days later and after several emails, I went back to the local bank. No corrections had been made and the overdraft fees were now $350. On my 4th trip to the bank, they were happy to tell me that they would remove one to the overdraft fees.

    I told them to put a hold on any transactions to my checking account and to transfer the entire balance of my savings account into the checking account. There was enough to cover the overdrafts and fees with about $30 excess. When I checked my checking account status, it showed a negative $31 instead of a positive balance. As soon as I can stop, all automatic deposits and withdrawals from both accounts will be closed. I would advise anyone to never do business with BOA. Their customer service is terrible and their fees seem to border on fraud.

Also I have been told by a employee of BOA that the Alert system they have in place is not reliable at all and people should not depend on it to let customers know their balance. I am happily mailing out an extra $35 to the CEO because it's pretty obvious that he needs the money more then I do. We are at the time where we get charged to use our own money.

    I am a customer of Bank of America for about seven years now. I have, in that time, never been overdrawn on my checking account, with the exception of one time last year, due to a check being delayed in being processed.

    I do online banking and operate on an alert system, due to my computer being hacked. I receive notification for withdrawals or payments over a certain amount. I also requested at the time of opening the account, that I would not want overdraft fees charged and that I needed the bank to deny payment on my debit/credit card should I not have the funds in the account.

    I also know that the bank usually sends notification by mail should the account be overdrawn, as an extra warning. My account became overdrawn on the 26th of this month, due to my pet plan insurance company billing me two months instead of one. This resulted in a cycle of events that has seen Bank of America take almost six hundred dollars in overdraft fees from my account. I used my debit card for small payments such as a rental movie for $1.05, a cup of coffee, etc. Each time I used the card, it was accepted. I received no warning nor was what I requested carried out. I was charged thirty five dollars for every transaction over the amount. Despite putting in my child support check for eight hundred dollars on the 29th, they took most of that amount in fees and then overdrew my account again, in overdraft fees!

    For small withdrawals of between one and five dollars, I was charged fifteen times a fee of thirty five dollars. Even with funds in there, it swallowed up all the money and then incoming bills overdrew me again. It is a carefully executed cycle of no win.

    I spoke with a total of four customer service reps, including a supervisor and a manager and none of them would waive anything more than one thirty five dollar charge, on the huge amount of almost six hundred. Firstly, I didn't receive notification. Secondly, I expected the bank to deny the charges if there wasn't money and thirdly, I received no online alerts either. It was as if though it suited Bank of America to keep these facts to themselves so that they could take the contents of my account.

    The result is the cycle has begun all over. I am a single mother and depend heavily on my child support deposits. It is only the third of the month and BOA has already drained the only resources I have until the fifteenth. Any charges made since then will be charged an overdraft again and I have no back up credit card or any other card to tide me over. The fact that I took the issue public to twitter and Facebook, did not phase them in the least. The fact that I told them I would close my account didn't bother them either. I got a stone wall all the way, flat out denial that I had requested a no overdraft policy and that they had failed to notify me.

    I have never had issues with this account, have a good track record and took the time out of the day - hours on the phone and online to try and get them to meet me halfway and to no avail whatsoever. That to me, is bad service, bad policy and plain greed. I have written to several forums in the hope of gaining their attention, but I doubt that anything will be done. It is unfair to decent, hardworking citizens who do not have huge amounts of money in their accounts to have these charges without some notification from the bank. Please publish this complaint in the hope that my voice can be heard along with thousands of other customers who have been ripped off like I was. Thank you.

    During the past couple of months, Bank of America has been using predatory collection practices consisting of calling my cell phone repeatedly. I do not have a loan with Bank of America. When I answer the call, a computer puts me on indefinite hold. Sometimes, they will call me every 5 minutes and I am forced to turn off the power to my phone. After thousands of calls, I was actually able to speak to a human named "Les". He explained that they were a collection agency and were trying to collect on a delinquent mortgage. I told him that I did not have a Bank of America loan. I asked if I could speak to his manager and he hung up on me.

    Bank of America still continues to prank call me everyday. I have not been able to get in touch with a human since "Les". If I try to call their 1-800 number, then I will get a recording which requests a loan number. I do not have a loan number since I don't have a loan. There is no option to speak to a human. Dialing "0" will not work. Bank of America is a scam corporation who has sunk so low that they need to prank call people who don't even have loans with them.

    I have alerted my business associates, neighbors, and family about Bank of America's predatory loan collection practices on people who don't have loans.

    Never get a loan with Bank of America. I believe Bank of America is trying to coerce or force innocent people into paying for loans that they don't have. Bank of America has such a deep level of greed that they have resorted to preying on anybody they can find. Bank of America ties up my cell phone line. They interrupt my employment by calling me repetitively during work hours. I have been forced to turn off power to my phone. I am paying for a cell phone service that is useless since Bank of America ties up the line. My business and family associates cannot contact me on my cell phone.

    I have all the records; there are no late payments. I paid Jan 1,2010 on 12/10 2009 and they applied it to principle. We received a late notice in February and corrected the simple problem. Received another late notice in July, Spoke to Sam in India, Ken W., Tariq in America, Sreyna in India. No one can correct the problem. Ken and American Tariq said they would call me back, problem resolved, no one called back. They reversed all payments since January back to late because they re-applied January's Payment back to principle and then reversed all ensuing payments which in turn resulted in them being classified as late and incurring late fees.

    I have spent over 8 hours over the last week and a half trying to resolve. Everyone on the phone understands. No one calls back when they say they will. Tonight I received a call from a debt collector, not sure if that means there is damage to my credit but I work 60 plus hours a week, and to spend my evenings spinning my wheels and getting calls from debt collectors is too much. Instead of admitting these errors, they are trying to intimidate us. All of what I say can be proven. We bank with these bloodsuckers and all the payments are recorded and we have the bill payment records. Any advice would be appreciated.

    Took rolled and wrapped coins into the bank around 10:55 am on Saturday. Bank was not busy. Teller did not want to receive. Asked me if I had an account with BOA. I said yes-my mortgage. She asked if I had checking or savings also with BOA and I said yes. She then asked if I had debit card with BOA. I said yes, but not with me. By this time I was getting irritated and asked if she had a problem taking the coins I had prepared. She said we don't take them unless you have an account.

    I asked why and she said it costs us money to process them and we have another source. I said, "I've never heard that before." She said, you would be surprised what you don't know if you don't work in the banking business. She gave me my cash but was totally rude. What would a ten year old child do with rolled coins from a lemonade stand.

    Can BOA refuse to cash in coins if I did not have an account? Was treated rudely and with total disrespect even though I've been a loyal customer of Bank of America for nearly ten years. It is not my primary bank and never will be with this treatment.

    Almost two years ago, Bank of America used North Star Location services in New York to collect on a bad debt for a customer who had the same name as my husband and lived in the same state. After they called my 72-year old mother-in-law to ask her how to get in touch with my husband, they harassed her to the point that they told her she was **.

    I called them to put a stop to it. They told me that I was a bad mother and needed to get off the phone, leave my dead beat husband, and take care of my kids. (My baby was crying in the background.)

    They then called my husband who left work to handle it in person with the only Bank of America branch he has ever dealt with. The branch manager called North Star Location Services to tell them they had the wrong man, but things continued to spiral out of control within the next few weeks.

    We pulled my husband's credit reports and found a lot of cross reporting with this other man. I strongly suspected that Bank of America was behind the problem since that was the only business with which the real debtor and my husband had an account.

    We disputed all the incorrect information with the three credit bureaus. Yet, Bank of America sent us letters saying they had been notified by Transunion about our bankruptcy. We have never filed for bankruptcy, and when I immediately requested a copy of my husband's Transunion credit report, everything was fine.

    Bank of America immediately sent us a letter apologizing for the inaccuracy, however, within days, my mortgage company and the company we had our truck loan through contacted us about our supposed bankruptcy. Many hours were spent proving our identity with all three credit bureaus, and everyone listed on the credit reports that we did and did not have credit through.

    We put freezes on everyone's credit in the house, disputed all inaccuracies with the bureaus, and we closed our savings and checking accounts and our credit card with Bank of America. The last credit reports we pulled were totally correct.

    That was almost two years ago. Recently, we wanted to refinance our house and lifted the freezes on our credit to do so. Immediately, my mother-in-law was called by Bank of America, and though our credit reports were great with scores of the upper 700s and lower 800s, my loan officer asked me about a "judgment pending" on my mortgage. She could see no reason why there had been such a thing as our account has always been paid on time and is in good standing. She said that she needed to get my mortgage company and Bank of America on the phone.

    I hit the roof. Why would we ever need to talk to Bank of America? My mortgage company says, they have no idea what is going on because my account really is in good standing and always has been. Bank of America claims that they have no idea what the problem could be because they show nothing on my husband as every account that he or I have ever had was in good standing and is currently closed.

    What the heck is going on? I pulled all six credit reports before we lifted the credit freezes, and they were completely correct. We are honest, hardworking people who pay our bills on time and do not live above our means. I could lower my interest rate on this mortgage refinance by %2.65 if Bank of America doesn't ruin it with their incompetent and inaccurate reporting. I am already $400 out of pocket for the appraisal. Bank of America needs to be smacked with a class action lawsuit!

    The bank closed our account in February 2010. I had about $5700 in my checking account and about $480 in my savings account. This money is not refund to me. I visited many times in the SeaTac branch where I open my account complaining over the money. No answer from the bank. Then they reopen my account in April without money and zero balance, and my husband deposited about $800 and they closed it again without any refund of the new balance. We tried to contact their customer service; they told me they will call back but no word from them.

    I visit the local branch almost every week to get my money back but no result. The branch staff has no convincing answer why they keep our money. When I asked if there is any other institution where I can complain or is there any complain forms from the State, Federal government or consumer protection agencies, they told me there is no such thing. Wait from us even if it takes years.

    I am a Bank Of America customer who used my BoA debit card to pay and sign up with a local fitness center. The center had allowed me to pay my balance in full by the following month. However, their computer system had taken out the payment 3 weeks in advanced. This caused a hold of funds on my checking account. So I contacted Bank of America and they told that if I contact the fitness center and have them call the bank, they would release the hold. I did one better. I went in person to the fitness center, spoke with their manager, who in turn immediately called BofA in my very presence, explained the error and requested of them to release the hold.

    So the rep at BofA did. However, 3 days later, my account was over-drafted $171.00 because they claimed that the fitness center did not put the release through in time and it charged. Excuse me, I said they put it in 3 days ago! You see, even though BofA knew the fitness center and Visa had released the money, they held it in their banking system just so they could levy 2 fees on me! I spoke with a.total of 10 customer service reps in 2 days, 6 of which have misinformed me, another 3 who blatantly admitted the fault was of the bank and that yes, they do see that both the fitness center and visa have released the funds back into my account, yet they still, to this writing, have not removed any of the overdraft fees or the funds, my funds,my money, back into my friggin' account!

    And this is coming from the same bank who went begging to the U.S. Government for tarp money from my friggin' taxes! And now they are trying to take from me again! I will be walking into their god-forsaken branch tomorrow with a smile from ear-to-ear to close my account. And mind you...I have only been a customer for 60 days! Bank Of America will go bankrupt again and shut down. Mark my words, people. Keep your money away from their grimy hands and do business with a company that is noteworthy! Chase bank, here I come!

    I recently moved from MN to PA and needed to open a new bank account. I went to Wachovia June 22, 2010. The representative at the Exton, PA Branch, Patricia, asked me what benefits I was getting from my previous bank and what my priorities were in a checking account. I explained that my priorities in a checking account are that I do not want to pay any fees, to earn interest from my checking, get free checks and get rewards from my check/debit card without a fee. She explain that I qualified for all these benefits if I opened a Crown Classic account and maintained a $1,000 balance.

    Last week, I received my statement and there was a $12.00 rewards program annual fee deducted from my account. Please note that there was no mention of this fee in the paperwork and package that was given to me at the time I opened my account and I was assured by Patricia that there were no fees associated with this account including the rewards program and all I needed to do was go online to register for the rewards program.

    Accidentally, I over spent with three purchases all less than $5. I was charged 4 fees of $35 to reach a negative of $167.00. I called to ask for a reimbursement and they said that I should learn how to use the account better and didn’t qualify for a reimbursement. My feeling is that they should have declined me at the first purchase that I didn’t have the money. They said that it’s a courtesy not to embarrass the account holder. I spoke to 6 people but got nowhere. What the hell kind of banking institution is this? And they say that they are there for you every step of the way. You can get no help and very rude employees. Does the corporate officers know about all these customer issues? I had to borrow the money from my dad to put in the difference and was out of that money. I’m only 17. I now have plans to close it.

    I deposited $60 CASH in the Wachovia envelope-free ATM on 7/15/2010, and the receipt updated my available balance. I checked my balance on the internet and it also said that I had over $300, more than enough to cover my $214 transaction with AT&T that night. I checked my account the next day, and it was charged $140 for overdraft fees, for debit items of less than $10 each.

    The next day, I was charged another $70 in OD fees, because of the prior day's overdraft fees. When I called customer service they told me the ATM balance isn't "really" my available balance. If I can't trust my available balance where do I go to know how much cash is available to me? In addition to that, in two locations on Wachovia websites, it says that envelope-free deposits are credited instantly.

    It reads, "Cash Deposits: You can insert up to 50 bills, in any direction, and the ATM will automatically sort, count, and itemize your cash deposit on the screen ,and on the receipt. Cash is credited to your account instantly, just as if you made your deposit with a teller".

    "Are my deposits credited faster? Yes. Cash deposits are available for use immediately. Check deposits made on weekdays by 8 PM will be considered received the next business day"

    If immediate availability is what they advertise, why was I charged $210 in overdraft fees? I have a direct deposit with Wachovia, and the bank took my whole week's paycheck.

    I gave a check to someone on July 14th 2010, thinking that I could move the money to cover it the next morning when I would have internet access. They deposited it immediately and the money was withdrawn from my account before I was able to make the transfer, resulting in four other items over drafting and $140 in fees, $35 per item. Bank of America returned one item, leaving me out of $105 after fifteen years as their customer. This comes at a time when $100 makes a huge difference, a week of groceries and gas for my family of three. It was unbelievable. More so, they told me that had I post-dated the check to the next day, had the recipient deposited it the same day, they still would have credited it and the same result would have happened.

    I am changing my bank immediately but I sincerely hope that this complain forum has some effect on this matter, though I don't know what. I have lost $105 in bank fees and will have to delay bill payments, tax payments, etc. to manage as a result.

    Went to make good on a overdraft charge got to bank 10 minutes before closing. I was told we are closing for today, told person at the door I had called ahead to fix overdraft problem said no problem come on got to bank denied entry Why?

    I would like to notify you of unethical and illegal business practices being done by Bank of America.

    I recently incurred several overdraft fees on my account. However, after doing a little research, I discovered that Bank of America is processing charges in a way to maximize the amount of overdraft fees that they charge. What is happening is that they are not processing charges in the order that they occurred. Instead, they process the largest charge first which causes all the smaller charges to be an overdraft.

    In my case, I clearly made several small debit card transactions first. Then I had to withdraw some money from an ATM due to an emergency. I knew the ATM withdrawal was going to overdraft my account ant that I would be charged a fee. When I checked my account, I saw that they took out the ATM withdrawal first which caused all the other smaller debit card transactions to become overdrafts. So instead of one $35 fee, I was charged this fee 4 times for a total of $140 worth of fees. Had they processed the payments in the order that they occurred, I would have only been charged one overdraft fee.

    I feel that this is unethical and illegal. They are manipulating the transactions in a way that generates more fees for them. This has happened several times on my account and I am sick of paying these extra fees. Can anything be done about this? I cannot fight Bank of America myself and need your help.

    We contacted them before we ever got behind in mortgage payments, and asked them to help us get into the loan mod process. They said they didn't have anything of that nature set up as yet (9/08). Then, I spoke with a neighbor who was going through a loan mod with his bank (Chase), and he asked if I was still making payments, and I said yes. He said no one is going to help you if you're still making payments! So we missed a payment finally. A year & 1/2 later, and we got the loan mod process started. We've been denied a loan mod, then, when it was discovered by Wachovia that they had crossed our files with someone else's, we started the whole process all over again, until we got turned down again.

    We contacted a lawyer (American Residential Law Group) to fight on our behalf, and paid them $1,650.00 to represent us in the loan mod with Wachovia-Wells Fargo. They're still telling us we may not qualify, because we make too much money. I'm a state worker in NJ dealing with frozen pay (just got a 1-1.5% raise ), but others have been deferred.

    I make a lousy $37,000, a disabled vet (40%), with a 2 year old kid, and a wife, who's reduced her work load as a hairstylist, to raise our child, and stay home (not making $35K annually anymore). I am unable to do part time work because of my work schedule, and our daughter. We thought this loan mod process would be pretty simple. Reduce the interest rate, extend to 40 years, or a combination of both.

    How difficult can it be to conform to the president's bill? Aren't they mandated to conform? It shouldn't take almost 2 years to get the loan modified. Besides if a homeowner like me, who didn't purchase a home out of the real scope of income dos not qualify, who the ** qualifies?

    We are already living paycheck to paycheck. We turned in one of our leased cars, and got a junker, which put over $400 back into the household income. We've cut back on utilities (through a state plan that was free through insulation, energy star products,etc). We are in an unknowing fog about whether we'll be able to keep our home. Then we hear about Chase renigging on loan mods with their customers (my neighbor), who initially agreed to a loan mod package, then found out he was in foreclosure? We need help and now!

    I have been banking with Bank of America for over 5 years now and I was under the impression that they at least had some idea about customer service and customer appreciation. Bank of America is nothing but a big scam hiding behind the banking industry. They say they are the bank of opportunity and they do make every effort to make profit out of every customer. They take opportunities away from us by charging excessive overdraft fees as they see fit. I have been hit with so many overdraft item fees because they process their transactions in an effort to maximize the fees.

    I have two checking accounts with BOA and on July 9th, I made a purchase of $150.00 from one account and I immediately did a transfer to cover my purchase. However, BOA did not post my transfer until July 12th and they hit me with two overdraft item fees. On the next account, I had transactions that were pending from the 8th and 9th for $2.25 and $8.00 and $5.00. There was enough money in the account to cover these charges. However, they posted two checks for $150.00 before they posted these transactions causing me to incur 4 overdraft fees totaling to $140.00.

    So because BOA doesn’t post their transactions on the day they take place, I am now left to pay $210.00 in overdraft fees, which they refuse to reverse any. I closed one account and as soon as my outstanding check is cleared, I will be closing the other one and taking my business elsewhere. I have put up with their ** for too long and they are not loyal to me so my loyalty is out the door. There should be some tougher regulations for banks like these who take advantage of their customers.

    On 07/07/2010, I walked into BofA San Francisco’s main branch on Montgomery Street and made a payment of $290.00 for a routine BofA credit card payment. On 07/08/2010, without my authorization, BofA withdrew another $290.00 from my checking account. This crashed my finances and I am totally broke. After numerous calls to BofA customer service, there have been no results. Two of the people I spoke to said the money would be refunded to my checking account in 24 hours—this was 34 hours ago. On many calls, they would pass me to another department and the line would go dead.

    As far as I am concerned, what they did is theft. I have no money in checking and I’m flat broke with numerous overdrafts happening. They basically "nuked" my finances. Not only do I want the $290.00 back, but because of this and other hardships resulting from this, I am also going to ask for a minimum $29,000 to cover any legal fees and other damages resulting from damaged credit.

    Wacovia incorrectly attached an insurance premium to our car note, claiming that our car was uninsured. We provided proof of insurance, received a statement acknowledging proof of required insurance, and a statement that our account would be credited. At the same time, they were still sending out payment due statements, charging us too much. We made two or three such incorrect payments until we could no longer afford to.

    Wacovia collection agents would not accept payment amounts less than what was on the bill, the same with automated phone and automated on-line. Wacovia literally forced to pay the wrong amount car note even after proof of insurance. When one could be reached, Wacovia representatives were ineffective, acted irresponsible and mostly non-responsive by phone. We kept getting passed on from one Wacovia rep to another, trying to get our account rectified. Then they suddenly came out and had our car towed away, claiming that we delayed our payments.

    When in actuality Wacovia delayed us from making our payment. Even while we tried to resolve the matter with Wacovia, they soon afterwards promptly sold the car for an amount they claim was a below market value and are harassing us to pay the balance of the sale of our car. I spoke to everyone, up to someone in the president's office who reviewed my documentation and declined my appeal for account correction.

    Wachovia forced insurance on me illegally. I have documentation from AllState, proving that my coverage homeowner's insurance never lapsed. I also have a letter from my lawyer dated last year, requesting that the Line of Credit and account be cancelled. They failed to cancel my account and then added the insurance charge this year. They also placed the line of credit on the wrong property. I am receiving harassing phone calls from them (for their errors) from this number.

    I went online to look at my account. I had $40. I got $38 in gas. Basic math: $40 - $38 = $2. Then, I had an iTunes charge hit at $9.50. Okay, I over drafted and got hit with a $35 overdraft fee, but tell me, why did they hit me with 2 overdraft fees? So, I called Wachovia and they said it is because the iTunes hit first. Okay, again, basic math: $40 - $9.50 = $30.50 and $30.50 - 38 = overdraft. Once, I was then told that according to bank policy, I get one overdraft fee for $35 for over drafting. I got it, but the second is because the account wasn't put back at 0.00 before it all posted so there was another overdraft fee.

    When I complained that that was the stupidest thing I'd ever heard of, he said that he could refund me $10. What? I understood the first overdraft fee and I accept it, but twice? That's $70! I am a single mother of 2. I don't make very much money, and so for them to take out $70, I mean, that's groceries for one week!

    I took out a prime equity line of credit with Wachovia in 2004. I have never used it and my balance has always been zero.
    Well, first off, they put it on the wrong property. I even gave them the pin number, lot number and address three times and they wrote it down.

    Five years later, when it came time for me to sell the rental lot, I had to race with a letter from my lawyer to Wachovia to get them to cancel the line of credit placed on the wrong property.

    They faxed the proper forms to my lawyer, but failed to cancel the account. The gentleman at my local Wachovia demanded a $100.00 charge to put the line of credit on the correct account, which I refused. It was their mistake, not mine. I found that my account had not been properly canceled six months later when I received a bill for $1,118.00 for an insurance policy that they forced on me because my homeowner's insurance supposedly had lapsed. My homeowner's insurance has never lapsed. I have faxed letters from my lawyer from my local Wachovia's fax machine) to other divisions of Wachovia/Wells Fargo in addition to letters and documents from my insurance agent.

    These letters and documents prove that Wachovia/Wells fargo failed to cancel my account and that charges were forced on me illegally. They will never admit that they have made a mistake and will swear you have not provided proper documentation unless you actually go to your local bank and fax the papers from there. Then you need to call the branch and confirm if they actually received the faxes. And follow-up because they will drag their feet, lose your forms, claim you left out a form, all so they can charge more interest.

    And then you will receive harassing calls from a different division demanding payment which you may or may not owe. Ask me how I know this. I am still fighting this out with them.

    I just have to voice that it is horrible how BoA's Risk Department treats people. The worst one of all was a man named Lorenzo. I was trying to explain to them the circumstances behind the overdrafts on my account. I asked two questions, one was once the account was closed what happens to the two direct deposits that goes into the account at the end of the month (June 30) and the 1st of the month (July 1), one for $1460 and another for $765? Lorenzo, told me that he didn't know. It may or may not post on the account and that they would mail a certified check out to me 10 days from the same day I spoke with them, which was June 25, 2010. (Which should have roughly been July 6th, due to the holidays. )

    So, asked a second question, since they are the risk department and had the power to shut down the account (and my other accounts that didn't have anything to do with the 1st), can he make sure that it at least stays open to receive those direct deposits because it has been already processed from my employers end and the VA has already processed it too? I didn't want over $2k to be in limbo within the mail system. He raised his voice, talked over me as he said that he has already answered all my questions then hung up on me. It was at that moment that I was so grateful that only God can see everything and that He has allowed all this to take place over the phone, because God knows if I knew what this person looked like (like if it happened at a branch) only He knows what I would have done out of anger.

    Went to the bank, they couldn't help. A bank manager looked at me as if I was a criminal when half of the NSF charges was their fault. (Posting incorrect balances, when in fact you have less) Then they have the audacity to charge another $35 on top of the NSF fees they already charged, for your account being in the negative for over 5 days. Back to Risk...prior to this fiasco, I had already been waiting over two weeks to get any money. I needed food for my children. I needed to get the gas turned back on in my house, and gas for my car.

    I called them back two days later if they would release at least $250 from my account and I am willing to wait for a cashier's check on the rest. I just have to get food on my table, gas in my car and gas in my home until either the cashiers check comes. They adamantly refused to help. They refused to help me with my own money! As of today, July 8th, 2010, my account is still open with now just $1400 in it, the other $600 paid for the NSF charges that it was in at the beginning of this whole crap, just called them, and now they are saying between the 15th and the 19th of July; wherein another direct deposit may or may not make it into the account. That's a whole month that I have been without for my kids.

    These people act like they are better than others the way they talk to people--the same people that was paying for the food on their table, roof over their heads, and shelter on their backs. God forbid they have kids too because you sow what you reap. God have mercy on the risk department and those on top who makes these regulations with the premise to make themselves rich by taking advantage of the everyday consumer and the politicians that keep them in business.

    My account is charged over $500 a month in late fees, extended late fees, and various other charges. I do not authorize automatic payments, and they accepted charges. I have a $35 Vonage and insurance for $30 from Bank of America that come in, but the bank monitors my charges. And as soon as I make a purchase, they apply the Bank of America charge and Vonage, and then, they charge these fees.

    I get paid $1223.90. This pay period, I was trying to pay my mortgage of $1100. They took out over $300 which means I cannot pay my mortgage. I feel this is a direct pursuit by the bank to make me go in to foreclosure. I have asked them to stop charging me these fees. I have monitored the account, and I do not feel like this is a good banking practice. They are targeting me to lose my home.

    Bank of America closes accounts without placing waivers so that the accounts incur monthly maintenance fees when the customers think that the accounts are closed. They don't notice this until a year later when the accounts are already overdrawn by $250. That's a straight-up scam. I was a former employee fired because I was accused of hanging up on customers which was untrue and now I'm pursuing legal advice.

    I was awaiting my transactions with Bank of America to go through all the weekend of July 2nd. I made several purchases and had funds to cover them. The transactions were awaiting to be processed July 3rd, 4th, 5th, and 6th. I checked my account on the 7th, Bank of America pushed a transaction for a check in the amount of $650 causing me not to have the funds for my previous transactions and having four overdraft fees. I tried to get the fees reversed and they told me they were already on the account. This is not the first time this has happened and I am tired of them doing this to me. My account was negative and I did not have the funds to cover any of the overdraft fees.

    I recently learned that for the past 14 years, Bank of America Merchant Services, in the course of processing our credit card transactions, had been charging my company a $10 monthly equipment lease fee for a credit card swiper we were not leasing. In fact, we owned the machine all those years, and BA Merchant Services' records confirmed this fact. However, when I asked them to rectify this situation financially, the best they could do, after much pushing on my part, was to offer me one year's reimbursement of $120. What an insult to my value as a customer!

    Once again, company policy takes precedence over honest-to-goodness customer service. Corporate greed supersedes a mere $1789 (including sales tax) goodwill effort towards the customer to do the right thing. Illegal or merely unethical? Regardless, this is entirely unacceptable in so many ways. Apparently, according to the all-powerful, all-encompassing, all-responsibility-null-and-void company policy, I missed my chance to correct BA Merchant Services' billing oversight approximately 13 years and 10 months ago, or within 60 days of when their fraud began. Yes, fraud. Since when has it become legal in this country to charge someone for a product that was never provided?

    Sure, BA Merchant Services claims it was not aware of this $1789 billing oversight. And of course they agreed to stop charging me. But what upsets me the most is that they don't care enough to take the extra step to make it right, admit accountability, and reimburse me for 14 years of dishonesty. You see, according to them, it was my responsibility to make sure they were charging me correctly. I suppose it was also up to me to go over every single credit card transaction they processed with a fine-toothed comb to make sure they'd given me the proper discount rate. Have you ever tried to do that?

    In fact, shame on me, I trusted BA Merchant Services to do its job, and to do it correctly. After all, this was why I was paying them every month, right? Without a doubt, my business' 14-year, $1789 billing error is small change for one of the largest banks in the world. They could easily reimburse my company without feeling a thing. But what if they admitted their culpability and had to reimburse thousands, possibly hundreds of thousands, of other businesses who were knowingly or unknowingly victims of similar billing errors? Then what? A class action suit? More bad press? Billions lost in bonuses? Do I care?

    Obviously, and for many reasons beyond what I've described, corporate America doesn't care about its customers. This isn't a new revelation by any means. In fact, we're even getting used to the apathy: the customer is never right, and the bottom line is all that matters. Here's my bottom line: a company policy should not absolve that company from the responsibility to do the right thing. Bank of America made a mistake, admitted it made a mistake, was given the chance to correct the mistake, and refused. Frankly, I'd have been surprised if they'd acted any other way.

    Where do we draw the line between indifference and downright shady, unethical business practices? It's so hard to tell, especially when the corporate marketing gurus develop and espouse their lofty Codes of Ethics and Core Values, when in actuality the front line employees who deal directly with their customers aren't educated and empowered enough to follow it through. Just take a look at two of the five "Bank of America Core Values" which can be found on its website (after much searching, I might add). "Do the Right Thing: We have the responsibility to do the right thing for our customers, shareholders, communities and one another. Trusting and Teamwork: We succeed together, taking collective responsibility for our customers' satisfaction. "

    Brian T. M., CEO and President of Bank of America, further states in his cover letter of its 19-page Code of Ethics (also found on its website), "With this honor comes a responsibility for ethical behavior in everything we do. " "The code, which is based on our company's core values, spells out our shared commitment to the highest standards of conduct. " "Trust is at the heart of what we do. Our customers and clients want to know they are doing business with a financial services company that they can trust; that all our associates will treat them fairly, communicate forthrightly, and make clear, honest and ethical decisions. Trust is crucial to the value we provide our customers, and it's fully expressed through the combination of our Core Values and our Code of Ethics. "

    Trust might be "expressed" on paper, but what about in practice? Bank of America will never win my trust again. But it does have the chance to act honorably to right a wrong, to act fairly, honestly and ethically by admitting it made a mistake and reimbursing me for 14 years of inaccurate billing.

    I have two checking accounts with BOA. I use one account for direct deposit and bill pay and the other account for vacations and spending money. I keep a $10,000.00 average on the direct deposit account and to the other account that I just opened, I put $87,000.00 in it last December. I have never had a maintenance fee on any of my accounts. I have several other banks I use also. I got a maintenance fee of $12.00 because I spent the money in it and haven't gone to one of my other accounts and deposited any money in it yet. I went into to BOA to see if they can waive the fee and transfer money from my other checking account to cover the minimum. They told me that I had to have someone review my accounts and get back with me.

    It took four days for Ryan ** to call me and he told me that I had to come into the bank and discuss my accounts. I work in a courtroom and don't have that luxury of just coming in. He told me to come after work on Friday and they are open until 6:00 pm. I live one hour from work and that's not an option on a Friday. I asked him why I had to come into the bank and meet with him. Ryan told me that he had "tools to utilize" for our meeting. I felt like he was trying to sell me something.

    I explained my whole situation with him just wanting the maintenance fee waived and transferring money or close the account because this was getting too complicated. I will just use another one of my banks for my spending money. He told me that the account was going to remain open and the maintenance fee was going to be in place until I meet with him. This is crazy! I told him that I could not care less about $12 but I didn't want anything to be against my good credit. I have never had a bad check or mark against my credit. My credit score is 860!

    I asked him who his superior was and was given Shirley **. I called her and she already had an attitude. Shirley told me the same thing as Ryan and I had to come into the bank to close the account. Waiving the maintenance fee was not an option. This is stupid. This is the second time I've had negative customer service from this bank. I came into BOA to finance a new home and got mad with them about their customer service and financed with another bank. This is the only reason I'm writing this letter. I could not care less about $12.00.

    I've been with BOA for about 25 years. This bank needs to be educated about customer service. I don't deserved to be instructed on my personal bank accounts. Plus, they wanted to know all about my other accounts and how I spend my money--like how much money I have. Just an FYI, I won the FL Lottery and that's no one's business but my own. I called today and got someone on the phone that waived all the fees and transferred money into that account. Wow, just like what I wanted in the first place--and it was done without going into the bank and in a matter of minutes. Please get some help to that Downtown bank. They don't know how to deal with people and getting them good customer service!

    There was another maintenance fee on top of the other one I didn't know about. I had no idea there was a $750.00 minimum on checking accounts. Easy mistake to have when I never get that low. Like I said, this was an account for vacations and spending money.

    Does anyone regulate Bank of America? On May 28 2010, a tree fell on our house. This caused an enormous amount of damage. Our insurance company was prompt and processed our claim in a quick and efficient manner. The check had to be processed through our mortgage company. Sadly, this is Bank of America. We are now 5 weeks since the back of our house was crushed and have not seen one penny of our insurance money.

    Here are the various answers I have been given via BofA's ever-so-friendly but useless customer service department.
    1) Send us the estimate from your adjuster. It will be two weeks from the receipt of this info before you get your first money. That was sent about 3.5 weeks
    ago.
    2) We have your estimate and are setting up the account, but it must go through IRS also.
    3) Okay, we have your check in hand. But, you must set up your account 7 to 10 days. Check was receivedd by BofA on June 15, 2010. We will overnight
    your funds.
    4) We called again. Still processing.
    5) We called again, and we're told that the check went out on regular mail on June 24, 2010. "Sorry, no notation that overnight mail was requested." Still no
    funds received.

    6) We called today, and we're told that the check was mailed on June 25, 2010. Still no check in mail as of June 30, 2010.

    I requested again today to please overnight future funds. "Okay, will ask supervisor if it is OK; will note that on account." I expected to call again, only to be told there was an error and the check was not mailed but will be mailed regular mail asap.

    This is not right! We are out of pocket more than $15,000, and the roofer is still awaiting payment. It is our money we pay the insurance company and Bank of America is using our funds and they are not out a dime! Bank of America is obviously pushing the regulations to the very maximum allowed by law. How do we get a bailout?

    We are home builders ourselves and are already struggling to stay afloat! Will you please help us get our money? This should not happen to anyone now or in the future. Thank you for any help you can give us. We cannot pay our own bills because we have so much money tied up in our house repairs!

    I had been working with Wachovia for 6 months to get a loan modification. I had sent in 5 complete updated packages and was very proactive. I called the processor on March 31, 2010 to see how the loan was progressing, she said to send in another updated package, I did and called again on April 6, 2010 to see how things were progressing.

    The processor asked me to send in bank statements so I sent them in on April 8th and called to confirm they had been received. I came home on May 3rd to find a 3-day notice to get out of my home, my home of 14 years had been sold at a trustee sale and the buyer was Wachovia. I was never given any notice thus allowing me a chance to respond or save my home. I have called every department at Wachovia to see what happened and everyone sends me to someone else, but will not allow me to speak to a supervisor.

    I have written letters to the head of the foreclosure dept and to the mortgage companies attorney, with no response. They claim I needed to come up with $775,000 but they turned around and sold the house to Wells Fargo for $435,000 on May 15th. I know I will be receiving a unlawful detainer notice any day now and I don't know what to do to save my home. This just wasn't right and Wachovia admits that my file fell through the cracks but say there is nothing that can be done at this point, but for us to find somewhere else to live.

    I'm not giving up until I have my day in court. How can they do this to us? They were deceptive and out of compliance but they don't seem to care, will a judge care? I lost our home of 14 years

    Wachovia representatives are threatening to not consider me for a loan modification if I do not sign form 4506-T, but they want me to leave lines 5-9 blank! This is an IRS form that clearly states on top “do not sign this form if any lines are blank." Wachovia refuses to budge. They say they will fill it in later. I asked them to send me a completed form to sign and they refused. This is blackmail and threats. There should be sanctions for this. I cannot get a modification. They are threatening to foreclose, further ruining my credit. How can they be allowed to have such threats and ask you to sign a blank form?

    On June 16, 2010, I clicked $1,200 as electronic transfer to a savings account at USAA Savings. Money was deducted from the account. Then on June 17, 2010, USAA reports only $700 was received. I have lost $500. Both institutions insisted the other was at fault. I'm 69 years old. My confidence in technology is damaged. I need the $500.00.

    Had a nice, small account with Wachovia. I had this account for few years. (Then Wells Fargo acquired Wachovia, it went downhill from there, to me). I used this for small purchases, just a little extra money for collectibles, etc. One day, I go to Wachovia to make my usual deposit. I was asked to open a savings account with only $10 to put in, thought this was okay. So, a couple of weeks go by and I receive my statement and, there was a withdrawal of $20. Unbeknown to me, this was because my account did not have $1,000 minimum! This was not explained to me at all! I would have not agreed to this had I known! Felt like I was kicked and, duped! So, I ended up closing this account! In my opinion, service has gone downhill ever since Wachovia got taken over by Wells Fargo!

    I had been unemployed for almost a year. I thought I had gotten a job through the internet. But it was a scam. I was given a check that had been stolen and was drawn on a closed account of a large out-of-town institution. I deposited this check in my Wachovia account. When I presented it to be deposited, their automated system refused the check; and the branch manager manually pushed it through for deposit.

    About a day and a half later, they cleared the check and made the funds available to me. I withdrew money against the check. Then a day later, Wachovia indicated that the check was not good.

    None of this would have happened if Wachovia had been more diligent and not made the funds available before they knew the check to be legitimate. I have tried to resolve this with them. The most recent communication from them encouraged me to pay them more than $1,000 that their actions cost me. I filed a police report related to the scam.

    I lost $900 that I had struggled to earn and borrow for my monthly mortgage payment. My account was now overdrawn by more than $1,000. I was not able to pay my mortgage. And I am now prevented from having access to a bank account. Not having a bank account is a big hardship.

    I did 3 debits which was supposed to have come straight out my account. Wachovia Bank held the debits and waited until a check came through to release these debits which they charged me $167.00 in overdrafts. I am sick of them doing this to people. They have done this many times. Someone needs to better manage these banks and what they do with people's money. Debits suppose to come right out your account, instead they hold them and wait to get a check when they can cause your account to go over.

    I've been a customer of BofA since 1983. I left the back in late 70s to go with Security Pacific when BofA lost $100 of mine and as soon as it was found I left. I was happy with Security Pacific but unfortunately the bank lost money and BofA took over and again I was back with Bank of America but not by choice.

    The first few years I didn't have any problems. However in the last 3 years the service has gone down considerably. Even more so now that we are in a recession. I was laid off from my job Sept. 2008 due to the failed economy. I was given a large check to as part of my severance. It was then for the first time I noticed BofA taking monies without my authority and unwarranted. In fact it appears they held the $15,000 check just so they could charge me $35 non sufficient funds. The funds were there in the bank but instead of applying the funds they held the check and charged me instead. It took fussing and 3 separate calls to get the 7 $35 charges reversed. Actually they only reversed 5 of the 7.

    After that I started watching my account more closely. I started seeing duplicate charges for things and would call customer service to report the duplicate charges and each time the Customer Service Rep. would tell me that it wasn't a duplicate just that it glitch in the system and that the monies had not been deducted from the account and to ignore. I trusted they know better than me and let it go but then on November 17, 2009, I received an email from BofA that there had been some unusual activity on my account. Someone had charged $433.00 to one clothing store and another $755.00 to Abercrombie.

    First of all, I've never spent that much on clothes at one time and never shopped at the stores mentioned. I called the back and confirmed that these were charges I didn't make so the CSR (customer service rep) walked me through getting a new debit card and said that they'd get it out right away and that the monies would be returned within the next couple of days. He also mentioned that there was another $800 that was pending and asked to cancel the transaction but he told me that they have to wait for the transaction to go through before they can react. The $433 & $755 had go through & those could be returned to my account but we'd have to wait on the $800. So he issued me another debit card and we discarded the previous one and he told me that he would take care of the rest for me.

    Well a week went by and the monies had not been returned to my account so I called to speak with a CSR. This time it was a lady CSR. She apologized for any inconvenience & said she'd be happy to assist me (she was very nice as was the guy that helped me earlier on that week). She said she didn't know why the monies had not been returned to my account but that she could see that they should have been on her screen and ensured me that they would definitely be returned the next day. It's now the end of Nov. 09.

    I gave it another few days and went about my business as usual. Do you know come December 12, 2009 they money still had not been returned to my account. I called and spoke yet again to another CSR. Do you know she had the audacity to tell me she doesn't see the transaction I'm referring to and that she can't assist me but to call back in the day and speak directly to someone from the branch. Well I call the next day trying to figure out what's going on and no one seems to be able to see the monies all of a sudden.

    Now the first 2 CSRs saw that the monies had been taken out of my account and saw the email I had gotten and told me that the monies would be returned in days but now the transaction had vanished altogether but yet they can see I was issued another debit card in Nov. 09. Strange right. In the interim, my funds were low because the monies hadn't been returned to my account and therefore a domino effect happened were I was getting NSF fees because they had taken all the monies from my savings to cover some of the checks I wrote out for bills and the monies hadn't been returned to cover the bills. I had another acct with BofA so I transferred funds 3 times to avoid any additional NSF fees.

    They used over $2,000 of my money for NSF fees claiming I was so far behind because of the NSF fees. They refused to return any of the monies and when I tried to discuss how this came to pass the CSR acted as though I was making up the story and pretty much brushed me off. I wrote 4 emails, 2 letters and made several calls. It's now June 2010 and to date my monies have not been returned and just recently even though I transferred within the last 4 months over $4,000 I'm in the hole because they continue to hold the monies and charge me numerous $35 charges for NSF. How is it possible to charge me when you have the funds and they are from the same bank and branch? They could actually walk the money over but instead they held onto the funds charged me non-sufficient funds over 13 times.

    I asked to speak to an account specialist although I had already put in a request a month prior for someone to go through my account activities one by one to see all the duplicate charges, the monies held which made my account generate the NSFs and the funds I never got back in Nov. 09. Nothing has changed and now to date I have $0 in the bank. I won't even deposit anymore monies until they fix this. I opened an account with a credit union and will never go back to BofA even if they are the last bank in the nation. I'd put my monies in an Eagle's nest before I'd give it to BofA. I plan to fight to get my money returned but once I do I'm going to take it out of the BofA and put in into the Credit Union.

    This is just ridiculous. You expect to have to watch your back for ID thieves. You don't expect the thieves to be your bank. You'd think they'd really want to protect you but it appears they only want to protect your money just long enough so they can rip it right from under your feet their selves. It's definitely a sad, sad day when you can't trust your own bank that you've had for over 20 years. But the trust is you can't so if you have BofA I advise you to go through your account with a fine toothed comb and I bet you'll find discrepancies of some sort if you do. Good luck and watch your back at BofA. It has destroyed my funds and my faith in the bank system. I'll never trust BofA again and I've been a customer for over 20 years.

    Today I took my paycheck, written from a Bank of America account, to my local Bank of America branch. In the past, when requesting a teller 'cash' my check then deposit it -so funds would be available that day- they have repeatedly deposited it as a check, leaving the funds to clear the next day. The bank manager actually told me I should make the teller hand me the cash then deposit it. Sigh. The teller nameplates may as well state 'Simpleton' on them. Okay, fine. There are two offending idiots I refuse to even use now when I go in.

    Today I clearly explained to the teller to cash my Bank of America paycheck. While she was processing it, I told her I wanted to put $300 in cash-I specified this- in my checking and take the rest with me. My daughter and I have birthdays this week so I was treating us to Chili's take out for dinner. She took my debit card and it was declined. The manager at Chili's stated we were the 5th Bank of America customer who had been unable to use their card after depositing funds today. So my daughter paid cash. Money that should have been available on my card. I tried to pay a bill online later in the evening and again declined.

    Looking at my account online I could see a deposit for the $300 stating it would be available TOMORROW. I've never seen that particular transaction description on my account. Even when the tellers were depositing as checks in error it was a different notation. So I called customer service. Even they could not explain why cash was on hold. This is ridiculous. When I call to talk to the Branch Manager tomorrow, I'd bet good money the whole thing will somehow be MY fault because I didn't instruct the teller as though she was first grader. I think I'll start talking to them like the morons they are from now on. And if-IF I find out cash is NOT being made available same day - complaints to the attorney general, FTC and FDIC will be next.

    I was charged $210 in unavailable funds fees. Over the weekend, I rented a U-Haul truck. They placed a hold on my account. This hold combined with several other charges reduced my account. However, I have learned that the reason I was charged six overdraft fees is because it is Wachovia's policy to deduct debits according to amount, meaning they will deduct from largest to smallest.

    Had they deducted the charges based on the date of the transaction, I would have only had one fee of $35. Instead, they reduced my balanced from largest to smallest, resulting in several charges for small deductions. They will not refund any of those fees even though I had over $1000 in another account at Wachovia. And I have had my accounts with them for over 10 years!

    I must preface this complaint by noting that after several years of doing business with this company, this is the first time I have been disappointed but I think it is an issue that could have a simple enough solution that everyone should know about. The ATM machine does not advise that it puts a hold on large checks deposited until after it has accepted the deposit, does not allow an option to cancel the deposit and the branch manager claims that an external contractor manages the ATM, so he can do nothing about it. We had a check for about $4,000. We could have simply cashed at the local branch of the bank upon, which it was drawn. Finding a long line in the bank where we wished to deposit it, my wife decided to use the ATM. Only after making the deposit did it inform us that a hold was on the check and it gave us no option to cancel.

    We immediately spoke with the branch manager and he stated that he could do nothing about it. He stated that it was supposed to offer an option to cancel the transaction if a hold was not desired. He just gave us this helpless "sorry" look and kept our money. He said he could do nothing about it. After two days, he could get the hold off the check and he suggested that we might get it done by calling customer service - the outcome of which has yet to be determined. He explained that an outside company services, the ATM, and they have nothing to do with it.

    Personally, outsourced or not, I think the Bank of America has responsibility to the consumer for the failure of their service to perform, even if a third party is responsible to them for it. Bank of America is the one dealing with the consumer and making promises to the consumer. By not informing us that a hold would be placed on the check before accepting it in deposit, Bank of America kept us from cashing it at the bank on which it was drawn and secured interest on the full amount of funds during the float time until we could actually draw on the funds. So Bank of America does gain something from this failure by an alleged third party.

    Meanwhile, consumers should know not to deposit large checks in that particular ATM if they want to be certain of immediate access to the funds. You will not be able to get your money, plain and simple, until they let it go and they will keep making money off it anyway. We had our receipt that says Bank of America had our money and Bank of America said too bad.

    Wachovia Bank is playing games with my accounts. After reading some of the other stories, mine is tame in comparison. They hold on to your money like an escrow account (hold) and give you a false balance. Now, they just hold that" hold" for many days in the hopes that you overdraw your account. Something must be done about all these bank that result to trickery. Is there anyone who can help for us?

    In summary, I was the victim of bank account fraud five years ago. I worked with Bank of America to credit back my account and open a new account. Five years later the bank abruptly closed my account based only on the fact that they closed an account in the past as a result of fraud. On top of this, they charged my account $50 before refunding my balance. In 2005, my Bank of America checking account was breached. I live in Seattle, WA and discovered a withdrawal from my account in Alabama. I immediately contacted Bank of America who told me my mailing address was changed in their system to an Alabama address. Apparently, someone was able to contact Bank of America, convince them that they were me, change the address on the account and issue a new debit card to the new address. We worked with Bank of America to close the account and issue a new checking account. The bank credited the account for the lost money and everything seemed resolved.

    Over the next five years we were very good banking customers. We conduct most banking electronically; we did not run overdrafts, owned a premium credit card and even owned a savings CD. In 2010 we opened new business checking and savings accounts. Bank of America also issued us a business credit card. Everything seemed fine as we started using the account for a new business. About two months later, we received a letter in the mail concerning the business accounts. The letter stated that Bank of America "has elected to close your account in accordance with the provisions of our deposit agreement and disclosures provided.” It goes on to state that Bank of America "may report the account to Chex Systems, Inc., an account verification service. This may adversely impact your ability to open an account at another financial institution for up to five years."

    There was no explanation for the account closures; however, it included a phone number for questions. Instead of calling the phone number, I decided to go into my local bank branch. The banking center manager told me there was nothing wrong with any of my accounts and did not know why the new business account would have been closed. The manager contacted the Bank of America Risk Identification Center and was told that the reason for the closure was due to a 2005 incident involving electronic transfers. They had no more information except to say that "any time an account is closed by the Risk Identification department, the customer can no longer conduct business with Bank of America."

    I explained the event to him and he proceeded to tell the bank branch manager that she could try speaking with bank management. Two days later I received a voice message from the branch manager apologizing for the policy, but that they could not reinstate the accounts. I went to the branch and visited with the manager again. She told me that the risk identification department has only been around for a couple years and was not even in existence when this episode happened. She asked if I had any paperwork about this incident from 2005 and I told her that Bank of America should have everything already. She stated that management would look at and consider any information I could provide about the 2005 incident. Apparently, the bank has very little information from five years ago and is asking that I provide it. Bank of America handled the matter in 2005 and did not provide me with any follow up correspondence as to the details after I reported it. She then stated that there was no risk to any of my personal accounts, the accounts I re-established in 2005.

    I decided to call the risk identification department again to double-check if there were any other reasons for closing an account in good standing. The woman on the phone confirmed that the only reason for closing the account was the event in 2005. She reiterated that it is their policy to close all customer accounts no matter the reason if the risk department initiated the close. I told her that in 2005 I contacted Bank of America and worked with them to close the account and reopen a new one. She could not confirm anything in regards to the matter except the bank policy. She didn't seem to have any information about the event.

    The risk department representative also had no idea about my current personal accounts (created in 2005 after closing the breached account). She was not even aware that I had other accounts. When I told her, she looked my personal account up by account number and stated that this account is probably in the stages of closure as well. With policies like this, Bank of America is passing the blame for security breaches to their customers. When this happens, the bank will blame you even if you are not the cause for the fraud affecting your account. In these circumstances, the Bank of America will close your accounts with no warning, post a notice on the Chex system for all banks to view and will even charge you a $50 fee to thank you for doing business with them. The consequences are $50, negative impact due to Chex notification notice, and the inconvenience of establishing new accounts.

    I opened an online checking account with Bank of America and had my payroll directly deposited to the account. I would check my statement daily online and would mark checks cleared in my check register. Well, the next morning, I would check my account to see that they had returned four or five of the checks that had showed as cleared the day before and paid a check that had come in later. Now, they charged me $35.00 for each check they returned. When I called the bank, I was told that the bank has the right to decide which checks they clear. I asked why the checks they returned were marked as cleared the day before and if this was true, then why have online banking?

    Well, needless to say, I made numerous calls because the same thing started happening over and over. I finally have a total of $600.00 in overdraft fees which I could not catch up. I called the bank to see how we could work this out--I was told to pay $300.00 and they would make the balance zero. They informed me this could take up to 30 days for my account to reflect the change.

    I asked if they could provide me something in writing stating that if I paid $300.00, they would credit the other $300.00 and make the balance zero. I was told they could not do that. They said I would have to trust them. I can't trust them, they already showed me that their intentions were not favorable. We went back and forth, but never could come to an agreement. Now, they have me with a check system and I cannot open another account anywhere. Can you please advise me as to what I should do?

    On Dec. 3, 2009, I checked my account balance and found out I was charged an NSF charge of 35.00. I had a balance but over the week end, I kept getting over the limit charges. I would go put money in the bank and I kept going overdrawn. Seven different times I went in the bank on Monday and the branch manager told me it was due to debit charges that had never cleared. Some charges it was like they wouldn't let them clear until the balance was low enough to allow another over draft.

    I finally spoke to someone over the phone who finally told me how much I should put in the bank because they were going to hit my account with three more overdrafts, so after depositing 340.00 dollars in the bank my measly 35.00 debit and my measly 11.01 debit finally cleared. That was my Christmas present from bank of America, I took my direct deposits out of their bank except for a small one that I immediately draw out non the first of the month. I want them to go through the expense of cutting me a statement. The worst bank in the United States. It cost 340.00 to clear up my account and completely ruined my Christmas.

    I have been charged with five overdraft fees at $35 each. B of A failed to deduct charges made on June 10,11,12 before a check came in on June 14 overdrawing my account. There were funds in my account to cover all the charges and the $650 check overdrew my account, however, they paid the check first and then deducted the charges made on prior days of June 14 to add overdraft fees creating five overdrafts instead of one. When I called and complained, the supervisor gave me credit for two of four overdraft fees (I thought I only had four) then I checked my online banking acct to see if the $70 was posted back to my acct to find I had another $35 overdraft fee charged the same day my auto deposit was made!

    Bank of America was sued for this type of practice, why are they continuing to create funds for themselves after being sued and told they could not do this.

    We have been a customer since 1969; they don't seem to value a longevity customer and unfortunately, changing banks would not be any better. I want this practice of overcharging overdraft fee to stop. I want $70 posted back to my account.

    I am currently being charged the $5.95 fee for online banking via the use of Quicken or MS Money application. This has been an ongoing issue since I opened the account. I was not really monitoring my money until I noticed the amount in my account was not adding up. I do not use any software for managing my money so I was shocked to see the amount being charged. When I called the first time, they were kind enough to refund my money. Now, I called and this time, they stated I'm being charged for simply accessing my account online. Looking at their fees today, I see that that feature is free of charge. Well, that was the straw that broke the camels back. I will be moving to another bank.

    I also am in the process of trying to get my money back from their own ATM. It has taken over two weeks for my money to show up and I suspect the amount will not match what I deposited. I will verify that later. In short, I used their new deposit system with four checks that I signed. The ATM scanned and processed the first one. The second one took awhile to scan but it finally did, then the third one took even longer but it never scanned the last one. The ATM shut down and printed me a receipt for the amount of only the first check and it never even printed the scanned images on my receipt!

    I instantly called the 800 number to report it and the person said it should show up within a few days once they processed the money in the ATM. If not, then call the dispute department to open a case. Well, five days go by and I called the dispute department and things only get worse. The first time I called, they made a case but never gave me the number and I didn't think twice about it. I then waited a few days and called back to follow up on the case. What case? There was none. So the lady then takes my case again and gives me the case number. I asked to speak to a supervisor and informed her how serious this issue is. She gave me the case number and assured me that the case was in fact open this time.

    Okay, I think to myself, this has to be the end. Nope! I then called back a few days later to find out that the case was open but they didn't have the right information in it! So for the third time, I stated my case. I got a new case number. I didn't even feel like talking to the supervisor knowing how futile it would be. Well, I looked this morning and saw the deposit came in. Now, I need to see how much is outstanding because it looks like I'm missing some money still.

    The Bank of America company practices unfair methods to charge their consumers overdraft fees. Based on my checkbook and the amount available each day, I am writing to express my disgust with your customer service practices and your unfair banking techniques. My checking account became erroneously overdrawn by your system of computing deductions from accounts. I simply use a checkbook and follow the numbers that are inside there in order to determine if my funds are sufficient. Because your company does not follow this simple, tried and true method, you charged me 5 (!) overdraft fees, to a total of $175. I accept the fact that I did overdraw on my last item, my charge at Food Line, and I knew that I would have to pay that fee.

    The practice you are utilizing is unfair and quite the racket in obtaining money. What makes this worse is that when I called customer service, the first operator treated me with disdain and like I was a criminal, with short words, an unclear explanation (like I am too stupid to understand), and indifference. When I asked to talk to a supervisor, she assured me that she wasn't going to let him change anything or help me either. When he finally came to the phone after a lengthy delay, he pretty explained to me that your system works that way, and it doesn't matter what day/order you make purchases on, and what money is available then; so much for accountability and common sense.

    It comes down to the fact that the bank can choose what goes through and when, and cause overdrafts. Mine was the ridiculous amount of $175. The common sense practice of basing overdraft fees on money that is in the account on the day of purchase is not utilized.

    I opened a passbook savings account at the request of a Bank of America representative as part of a promotion in March of 1995. Sometime later, I went to close out my account and the bank representative told me the money was sent to the state. For years, I have periodically checked with the state by phone and on the web, but they have no record of anything held in my name.

    When I ask for assistance from Bank of America, they tell me to contact the state. When I ask them to research it internally, they refuse and tell me it was too long ago. I keep getting the run-around. Meanwhile, the money I deposited with the bank is as good as gone. I still have my passbook and an old bank statement from March of 1998. The original $25.00 plus interest would be in the thirties by now. The frustration and aggravation caused by their disregard for a customer that has had their money taken from them is far greater.

    My current account was charged $595.44 for a three-year old account overdraft fees in which I had no prior knowledge of. I was given no explanation or provided any proof. Bank of America just ripped me off! Telling me to go over prior statements from three years ago and that they didn’t see any wrongdoings on the banks part, although they could not prove it to be true. The consequence is $595.44 deducted from my personal account, which left me and my family in an incredibly difficult financial state.

    My complaint is in an all time high. About a month ago, I had withdrawn money from a Wachovia ATM machine. I guess all I was focusing on was getting the money to pay my mortgage. So after I got the money, I accidentally left the ATM card in the machine.

    I called Wachovia and they told me that they would send me another card for $20 expedite or $5 regular mail, in which I did the cheaper of the two. Waiting was wrong and you had to pay for it and wait. I left the card in their machine and they still charged me for another one?

    Twenty dollars for faster service is a rip off and they know it. I guarantee that you, Wachovia, has made millions in ripping people off. I thought Americans were in a recession and we do not have to continue in a downhill spiral to be taken advantage of. It's sad that they have over 15 states that they are doing this to.

    Why must banks be so greedy? Withdrawals also need to be increased as well. This shouldn't be.

    Basically, by not having a full time job, they are actually taking away money we all need. Every $20, $5, $1.95, 50 cent and etc. counts, we get a small income. Shame on the banks that they are still stealing money. Are they ever going to stop?

    They forced pay $401.98 from my checking acct for a closed acct in CA. Bank said I had the money to pay when in fact, I did not and the amount taken was mostly for fees; the actual amount was only 78.00! The purchase should not have gone through if there were not enough money! It left me a negative balance of $400! I had just paid rent and the bank was threatening me with fees of $35 per day! So, to fix the problem, they reversed my rent payment! Now, I have to pay my rent late plus interest on my rent!

    I called the division in MO which handles the force pay collections and was told I owed $395. I stated the amount was mostly for fees. They were unsympathetic, unapologetic and said if I wanted to dispute, I should have done so in February! They changed the ledger online to make it look like it was my fault! I checked my balance every day and did not see the force payment until the 2nd of June! They said they took the money out on 5/28! That was a complete lie! I was paid that day and paid rent with the money in the bank. It was a holiday weekend and there was no way of knowing until it was too late!

    These people are crooks! They changed the ledger fraudulently which is against the law! But big BofA against me, like they're not going to admit they broke the law to collect an unjustifiable debt, not my fault! I have been a BofA customer for years! I have never been treated so badly and with such lack of concern or ethics!

    This is the 2nd time that Wachovia has passed charges from larger to smaller, even holding off on passing certain charges to my account that had come before the largest. The first was in March 17th, when they held off passing my direct deposit payroll till after midnight, yet then passed the other "holds" through before my payroll check which then put me into overdraft. Some that hadn't even been charged by me, it was an automatic gym membership that was in my "holds" that pushed me over. It didn't even go post to my account from "holds" section until after midnight and my overdraft was on the 17th!

    Another that I can prove shouldn't have been held, as it’s my cell phone bill that is due on the 12th or I will be shut off but was passed on the 17th and I have the receipt for that. They charged me $175 in overdraft fees, again this all happened in one night. When I tried to speak to someone on the phone about this, they passed me from person to person, and no one could do anything for me. I stated that they should have declined the gym membership if it would have put me into overdraft, as I had money in my account, just not enough to cover the membership fee at that time. They chose to pass something which I had expected to decline. (If I don't have the money, decline it!) I was even told by one snippy rep, after a long conversation, that I should "keep better track of your money ma'am and then these things wouldn't happen, now would they," (they record all calls so it's on there).

    I was blown away. I stated I wanted my "overdraft" turned off, that I would rather bounce a check or have my card declined, than have my hard earned money taken from me as a courtesy to myself! They offered me $28 returned from the overdraft fees (how sweet) which I of course took as it was the best I was getting. Fast forward to June 8th, and I log on to my account, which if all charges had passed in order. I would have had $6 left. Upon logging on, I see that I am negative $208. They, again, held off on previous charges in order to pass from smallest to largest, which then put me into overdraft, which I will say I would have been, but for only one charge, not 5.

    Also, on September 23rd 2009, Wells Fargo announced a change in policies in that they will charge no more than 4 overdraft fees per day, which my total of $208 is $5 in one day. This is false advertising (I have the press release printed off, and it came from Wells Fargo's own website). Now I tried, in vain, to deal with a bank I have been with for years, and no rep would do anything for me, not even another measly $28 like the last time.

    I am tired of accession overdraft charges that I don't even want, decline me, bounce me, but don't take up to $200 of my money to "pass charges for your benefit ma'am." I cried at work when I was the negative $208, which was jarring to me. I am now a single woman driving home from work late at night with no safe cell phone for the next 2 weeks as I cannot afford my bill. I am the sole income in my household of 2 people (as my sister is out of work and trying to get unemployment). I have had to contact Carlos with Fidelity Bank to cancel my car payment because that check, of $200, is now being taken from me by Wachovia. I will now have a $50 late fee for my car loan and a late payment spot on my credit. I have no groceries or gas and as I’m writing this. I’m still not sure how I'll eat the rest of the week (its Tuesday). I'm mad, scared, sad, hurt and just lost for how to deal with this, feeling like it won’t ever get better.

    This situation actually keeps happening. When things are in a hold status, they show on the hold page, but when they have cleared, they show on the regular page and do not show pending. Well, this one particular transaction showed cleared and the money was not returned and it was still out of my balance. Then all of a sudden it pops back up again when it had already cleared. This is not the first time that this has happened to me and it probably won't be the last but I don't have money to waste while Wachovia bills me for $35.00 a pop in insufficient/NSF fees. When I had done my calculations in the ledger and on the computer, I came up with a balance of $.66 left until my deposit goes in on Tuesday night. Somehow after clearing the same $10.00 showed up again and clears again and now I am in overdraft by $79.00. Are you kidding me?!

    Then they tell me well you are not eligible to get any funds refunded! What a load. They are just taking people's money without any remorse or show that they know they are doing something wrong. I wrote them this message and I hope that they get it. As much as I talk about how wonderful Wachovia is to my friends and then they change over to Wachovia and you all continue to tell me that your computers do not make mistakes, and that the people that you have working with you do not make mistakes. No one is infallible; everyone and everything can make a mistake.

    Last week $10.00 was listed as cleared right above a shell station debit of $10.00 as well. Somehow, it disappeared and then reappeared and took my account into overdraft. This is ridiculous! I have never been so displeased with the amount of service that I am receiving. I keep a tight accounting book on our records because I am not working anymore and even then was only working part time, we don't have money to waste. And all I keep hearing is that you all don't make mistakes.

    I am done with Wachovia, as soon as my account is cleared I will be moving and telling all of my friends what kind of crooks exist at Wachovia. I will also be posting a blog about this entire transaction and all of the others that cleared and then disappeared and the reappeared. You don't care that people are struggling, you all don't care that people are having funds problems. All you care about is the bottom line. And if I had the page that showed this error on your part, I would definitely have shown you all and posted it online as well. You all have a Blessed and Wonderful Day! They are such jerks. I hope that they go belly up!

    The bank as a whole charges ungodly amounts of NSF fees to the consumer. They put a hold on my deposit so they can charge me NSF fees. There was this one time my wife deposited a check from our account with the credit union personal account to cover a check we wrote to pay some bills. The credit union had made a mistake on their end and caused the Wachovia account to go insufficient. The credit union covered all the NSF fees and wrote a letter to explain what had happened, but Wachovia still put a hold on all the checks that we deposit. When we looked online to check our balance, it showed that the funds are there, but on hold. The only way that we can use our account is to put cash only in. I started to investigate Wachovia online and had seen that thousands of people had problems with Wachovia banking practices. Wachovia looks for ways to set their customers up for NSF fees.

Caused my account to overdraft several times do to a technicality of 3 minutes. Could not pay my bills and put me weeks behind. A total of almost $400 bucks in overdraft fees assessed.

    I have a debit card with Wachovia Bank. I noticed over Labor Day weekend that my account had a negative balance and I was shocked to find out a check had not cleared (my error) and due to that, I had a $4.00 negative balance. When that happened, the bank charged me an overdraft fee of $70.00. I went to the bank on Saturday, hoping they were open. They weren't. I sent multiple emails to the online service and advised that I knew of the error and I needed to get it taken care of as there were several small charges that would be coming through (they were made prior to the original overdraft).

    Well to make a long story even longer, they kept charging my card over the Labor Day weekend and the following week, even after I deposited $500.00 cash plus $500.00 from another account with another bank. For whatever reason, the overdraft fees kept mounting, even after they sent me an email stating a "review board" was going to review my account (this was when it was $290.00 in overdraft fees). Well I don't know what they have done, but now my account has $500.00 in it and they have taken $690.00 out of my daughter's account and she is not on my account nor am I on hers! She is a college student and on a limited income.

    Wachovia did this without notifying me or my daughter. They keep doing these acts on the weekend, when I am unable to talk to anyone or prevent further snowball effects (i.e. increased fees). Please help me. They (Wachovia) say they will review, say they will call me, etc. How can they do this? Help me please!

    Merciless rip off! I was so very inhumanely abused and dragged by a certain system. It took more than an hour to clear me out as an American Citizen who is still alive because I was reported dead by perpetration. I do 100% believe that there is a footprint stalker who is following all my complaints and get it embezzled, laundered, abused and more complicated by false claimants who always wanted false claims to make themselves wealthy and kill victims by putting them in ditch and make them scream behind their supervisors and report them for different kinds of false and opportunistic citations which is evil. I might be reported dead again, God knows. I have the sensitive numbers that were called and entered to double make sure that I am still alive American Citizen.

    How much money was wasted and is being prepared for false claimants who might turn up as angry defrauders and use different tricks to make my life more miserable and make me and my likes scream because of justice? Why the system is specifically very conservative on certain targets and pays all the targets' money to footprint stalkers who are not even afraid to download communications like this by virus and monger fear on courts of laws without any fear by deception? I am very hurt and I need an immediate settlement ASAP before trap is prepared by a white collar criminalizing group that kills by "Their Own Rope" as it calls it. More than 1,000% emotional destruction! I feel destructed and solicited by certain false claimants by deception.

    I wire Transferred $8000.00 from my CHASE debit account on 5/27/10, for the purchase of a vehicle, and it turned out to be a complete fraud. Now CHASE is saying that they cannot refund my money and Bank of America, is refusing to return it as well. I need you help as soon as possible! I lost my $8000.00, and I got no car as was advertised on the internet ad in the Auto Trader Classic cars magazine.

    I had overdraft issues with Bank of America in January, so to avoid any more overdraft problems, I spoke to a manager who explained to me that it was possible to put an application on my account or card wherein when I use my card and I have insufficient funds, the card would decline.

    I didn't understand all that he was saying but I asked at the end of the conversation if he was sure my card would decline if I had insufficient funds and he said yes. So I made sure not to overdraft after that. In April, I had used my card for a couple of dollar purchases not knowing that I didn't have enough money in my account. I assumed the card would decline like I was told but it didn't.

    So I got overdrafted over 200 dollars. When I realized this and called the bank, they told me sometimes the card actually doesn't decline, which I thought was so unfair because if I had known that I wouldn't have it, in the back of my mind, that the card would decline with insufficient funds.

    I had a problem like another person stated. I had funds in my account and was charged three thirty five dollar over draft fees to equal to one hundred and five bucks. I was shocked and called them about ten times. They are all not seem to understand my problem or was ignorant. They said that I purchased three small purchases. One at Subway for five bucks another at a thrift store for three bucks and a gas station for eight bucks.

    With the first purchase, I was told my account was over the limit thirty five cents and they charged me thirty five dollars over draft fee but that is a lie! I had the money in the account and online showed that I had the money in the account. No one seemed to understand this. I was also shocked at how mean and rude all the representatives were. I called times times to be exact. The final time I called, I got a very nice man who even gave me his name and said he was here to serve me. He did give me a one time credit of just thirty five dollars to help me out.

    I am still upset because I was charged one hundred and five dollars in fees when I had money in the account! I used to have Bank of America and this happened before but it was my fault and they even credited me back all the money. They were nice too! Wachovia must have trained their employees to just say no to everything. They even say no to even there own mistakes. So they could see right there that I had money. Mom told me to just go to the bank near us, and show them online and explain what happened and I am going tomorrow.

    Since closing my account next time they try to take money from me, I will not pay it because I am stopping my direct deposit and will take out only the money I have in the bank. I can't afford this to happen every month. It has only happened this month and I have been with them for about six months but I am leaving this company and switching back to Bank Of America because I had them for ten years and no problem but grandpa has a savings with Wachovia and that is why I switched.

    I even told some of the reps over the phone that my grandpa was wealthy and I will switch banks and he will too but they did not care. No refund and no explanation, that I was satisfied within what happened with my account! With the ninth person I talked to, I started to cry and have tears. I talked to a mean lady who said there is no way they are even allowed to give refunds and she looked up my name to see if I was qualified for a refund and she pretended because she came back to the phone in five secs to say no. I begged and said please, this is all the money I have in my account and you all stole from me. They did not care, did not care that I was in tears and knew I was crying and had no money to live on.

    I was so upset. You have to leave this company, please. They were so rude that it just made me more upset and believe it or not I was polite about it.
    By the tenth person I talked to who helped me, I could tell from his voice when he first picked up the phone and stated his name I just knew he would help me.. I needed that money because I have to go to school and I have to eat and I have no family. I had thirty three dollars dollars to live on for one week.

    They stole from me. I could have starved to death with negative two dollars in the bank. Thank God that he refunded at least thirty five dollars, even though they stole the rest. I told the reps that I would starve to death and had no gas money either. They said, "Oh well." I mean I was serious! My grandfather has money and he does not even help me. I am a loner. I really have to only depend upon myself!

    They were all cruel and evil when they could have easily sent a refund. The first nine people which eight were women and one was a man and the person who refunded me was a man also. If any of you guys reading this have Direct Deposit with Wachovia cancel it fast. They will send you fake over draft fees! I read other reviews where the same thing happened and I was surprised I was not the only one.

    I opened an account with the Bank of America and asked for an account with out bank charges for using my money. I called and asked what address I could send my checks to. I was given an address that turned out to be there call center. I had all the money except what I had in my pocket to that address to be deposited. I kept on checking my account on line and did not see any deposit. I called and found out that they had given me the wrong address. I called at least 8 different people and the basic answer that I got was to resolve the problem my self. They really did not want to do anything. When I said that, I was recording the conversations, I was told that they would not talk to me if I record them.

    They were recording from their end. The reason that I recorded the some of the later conversations is that I was given false information. I call the Fed's and was told that what they told me was not true. I would not put my dog's bones in their bank anymore. I would not use them if I were you either. I checked some of there ratings and seems that they would not be doing good if it were not for tarp. Stay away. I spend the Memorial day week end and had to cancel all my plans because they had lost the money I sent them.

    In 2006, I was minding my own business as I was making a deposit into my Bank of America account. A teller asked me if I had heard about "keep the change." I hadn't and she began to explain to me that the change from my deposits would be put into a savings account. I asked her what was the catch, she said there wasn't any. I told her I didn't have time to come in. She said she could set it up at that moment and mail me the details. I received a couple of savings invoices informing how much was in my so-called savings account.

    My last statement showed I had a balance of $197 and some cents in it. I had overdrawn in my checking and went to make a cash deposit. I was short a couple of dollars and was going to have some taken from my savings. This rip off told me I was overdrawn in my savings. I was totally upset! I asked, "How could this be when I had never used the account?" This rip off told me that it was a charge for them putting it in my account--this was their idea. How crazy is this? Bank of America is a total rip off!

    I have been with Bank of America for 3 years in 2009. I was charged $1,800 in overdraft fees in throughout 2009. So I then opted out on overdraft coverage because BOA manager bill from Branch Worcester told me it was a good idea if I did not have the money in my account when using my ATM card, it would be declined and then I would not be charged any more for overdrafts only if I used a check and it did not clear and I then would be charged one overdraft.

    Well, to my surprise I over-drafted when my mortgage payment went through. I should have only been charged one overdraft but was charged four because BOA changed the order of my debt card purchase dates to later time to overdraft my account four times. I asked them to refund me; they keep saying they can not because computer won't allow it. Also, they say it’s not my fault or them personally. It’s BOA’s bad policy not giving them (BOA worker manager) the ability to refund me. Also, the BOA employee had stolen BOA account number; BOA notified me by mail. I checked my account and it was in the red. They stole all my money. It took them 2 months to pay back the amount and they also stuck me with some overdraft fees. Throughout my experience with Bank of America overdraft abuse, I became delinquent on my mortgage and have had no money for food or gas and also suffered depression and almost lost my home.

    My bank account was illegitimately charged $70 in fees for transactions that were in fact covered, and I have proof of all transactions being covered. My bank account had sufficient funds available for all transactions, yet the bank charged my account for 2 transactions in the amount of $70 for "Overdraft Fees". Upon bringing this to the attention of James **, Supervisor, he admitted on record that the transactions, for which he would not refund the Fees, were in fact covered, then refused to acknowledge this any further. He admitted that the bank did not have to cover any transactions on my account whatsoever, because all transactions were covered.

    On 5/29/2010 I called back and spoke with another customer service representative who refunded my fees because they were illegitimate. I have screenshots to prove the bank account was NEVER in the negative and that the bank never had to pay for any of my charges on my behalf. Today, June 2, both of the fees reappeared in my account. I am short on my rent which will now have to be paid late, and I am not on a lease so this could mean an eviction, although I hope not. I also cannot afford to lose $70; I am a single mother with no other income but my own.

    My roommate made a deposit at my bank for $800 for rent, $200 of which was cashed and the rest, a bank deposit from their account at Citibank. The Bank of America account rejected the payment twice, as it would clearly reflect in the account and then appear as an IRX transaction in the form of a debit from the bank itself. After calling Citibank and Bank of America several times, they had my roommate go into a banking location to "verify their identity" saying this was the problem. My roommate did this at which time Bank of America ensured they would put the transaction back in and credit my account the $800 (they had never posted the cash to the account either).

    I saw the credit for $800 almost immediately. Unfortunately, they then debited my account $600 under the description of only "Bank of America". I have called everyday for the past 2 weeks and they have yet to correct the problem. I have had no access to my own bank account for weeks including a holiday weekend (Memorial Day 2010). No way to buy gas, no way to eat for over 2 weeks. I have been left with no other choice than to file complaints with the OCC, political offices and major media outlets. If this was by some way an isolated incident, I would have more empathy. However, this is one of a long string of similar events. Bank of America has taken money from me and their customer service associates "recognized the error and are doing everything they can to resolve the matter".

    I do not consider 2 weeks prompt nor "doing all you can do". Not only have they applied bank fees to their own debits, they just can't seem to give me a correct answer on when I will see my account back in the black. Not only has my identity been stolen several times in the last year, only a couple months ago, a bank associate pocketed a cash deposit made into my bank account. This has got to end. There has to be some form of consequence for Bank of America not to adhere to the same rules and regulations as other banks.

    I was charged a $35 overdraft fee on 8 cents worth photocopy at Staples. I contacted C.S. at Wachovia and they basically said, "too bad". Several checks didn't pay and we ended up with an additional $270 in bank fees.

    Bank of America let a fictitious person/persons take $300 out of my account, and when I called to complain about it they told me I would have to fill out some forms. The forms were then sent to me by fax and by mail. I completed the forms the same day that I received the fax. When I called the fraud division they told me I was a day late getting them my forms even though they had sent me the forms that day. I was told there was absolutely nothing I could do about it.

    Wachovia has subtly, and sometimes not so subtly, tweaked their system to maximize whatever fees. They will delay deposits (I have a friend that receives EFT's from the state for their business as I do-these go out the same dates for everybody but my friend has a normal bank and their $ shows up a day before mine does) and speed up and/or hide debits so you don't know they are there. They are scammers.

    They do not just maximize ISF fees, if you have one account covering another, they'll charge $10 each time their computer (automatically) goes through the arduous task of simply moving $ from one acct to the other. State Employees Credit Union charges 50 cents for this. I called Wachovia and asked how much a wire transfer would be and they said $40 plus $22, so $66. I said that was outrageous and the guy said it was because the Federal Reserve System charged them. Not trusting Wachovia not to try to gouge me and not being dumb enough to believe this guy, I went to SECU and they did it for $6! I've seen lots of posts here too about their Laissez Faire attitude towards account holders. They truly do have Southern customer service. I left a message for our branch manager Chris here in our hometown after being treated rudely and, of course, he never called. Trumped up fees, near fraudulent behavior and shoddy customer service resulting in anger and despair and going through the pain of shutting down of our accounts.

    I owned 5 securities of Verisign that I bought around 8 or 9 years ago. Two days ago, I got a letter from Wachovia stating that they had sold my shares without my authorization. I think this is highly illegal as these are supposedly securities so they should be secure from someone other than myself to sell them. I called the number on the letter that was sent to me and spoke to an operator who was shocked that this had happened. She then looked into it and said that Wachovia had added a fee of sixty dollars a year onto my account in January and because I had not paid the fee, they sold my shares to cover it. I never got any information from Wachovia/Wells Fargo informing me that they had added a fee onto my account. I would like to take legal action as I feel this is a criminal act that should be prosecuted fully. I lost money on the unauthorized sale of my shares and my account was illegally used without my permission.
