I owed a balance of $42.39 on my Bank of America credit card. I tried to pay online, I forgot to put in a decimal point. They took it as $4,239.00, loaned $2,900.00 because of overdraft protection, took the money right back out and charged fees of between 150.00 and 200.00 dollars to pay a $42.39 balance. I tried to get my money back, no luck.

In 17 months, Wachovia has charged me $1,890 in overdraft fees and refunded $356 or a percentage as determined by them that has no rhyme or reason based in mathematical calculations. I receive SSID and the fees happen 8 out of ten times at the end of the month, when they will be assured payment by simply taking from my direct deposit. Things happen like holds being reversed and even though there maybe (true example) $95.23 in my account before a $55 auto debit comes in on my online statement leaving a balance of $40.23; the unavailable funds notice they send in the mail states that I had $35.23 before the $55 debit came in.

Not only that now the debit card purchases I had for $5, $4, and $2.82 were now bounced. The bank used to state that they only backed out smaller debit charges and took larger payments because the larger were probably mortgage payments. Well, I have also had charges of $120 and less backed out. Never have I seen anyone today with a mortgage today for those amounts unless they lived in a shed or a dog house. I have complained until I am blue in the face. They have gotten so ignorant now that they just say we can "offer" you x amount of dollars out of the money that they know they stole from powerless victims. I can't leave because I have to give Social Sec 30 days notice to change banks and it must be after the check deposit date.

I have had an account with Bank of America for many years. I added my husband to the account after we were married. He had a work truck that he was financing with an outside finance company. The truck was stolen and he received a check from the insurance company which he deposited into the Bank of America account. The police recovered the truck and it was returned to the finance company. After the money cleared, the finance company did not return the truck to my husband, so he went out and purchased another truck from a different company. Now Bank of America has a judgement against us for the amount of the check, and we did not even know about it or why.

This person and others call me in my work hours and say bad words. “You no pay, I speak to your boss. You are the bad person,” and others. I said please call my cellular phone, and when a different person call me they do not have the cellular number. The person said bad words to me because I said this information I gave and I do not want all the people to have my personal information. I have problem in my job for these incidents. I do not want to lose my job. I feel sick with the problem with my nerves and I have problem in my job because the persons do not have an education and say bad words (i.e., you are the bad person, you do not want to pay, etc.). I explained in my job that I have a problem to speak with--personal issues.

I was added to my father's checking account on 2/20/2010. He has held this account for more than 30 years. On March 27th, I noticed an electronic check was presented on the account that neither myself nor my father knew about. After researching the account further, an unknown company was presenting the same check each month in the amount of $300 as far back as November 17, 2009. We reported this to the branch and we were told that we needed to call the fraud dept. We were placed in a separate room to call the fraud dept.

The dept. took our information, told us we needed to close our current account and they would let us know the status of our claim within 2 days. It took about 3 hrs. in the branch to report our claims and open a new account. Later that same day I received a phone call from Crystal *** in the fraud dept. informing me that none of the money will be returned because the first check was cashed more than 60 days and the current check that was cashed on March 16th was from the same company. If the check that was cashed on March 16th was from a different company they would have considered our claim. I was not on the account on November 16, 2009 and reported the bogus check to BOA as soon as I became aware. BOA has treated my father and I as if we are crooks. My father is 77 years old and on a fixed income and in addition to paying $900 for the bogus checks, the amount of overdraft fees he has paid add up to $210.

We have been working unsuccessfully with Wachovia Mortgage since Aug. 2009. They were just bought out by Wells Fargo 3/20/10. We had been told for over 6 months at the beginning of 2009, we couldn't do anything because of the by-out until it was further along. We are on our 5th attempt to go through the HARP program for our home mortgage. Because of the economy we have fallen into a financial crisis as others have done. We have tried to hang on with our very small business by relying on credit cards hoping the economy would pick up. It has not.

Wachovia has put us off for many months before they would even discuss modifying our home loan. We have kept records of our calls, and folders 5 full of documents and notes, of our staying in contact with them. They have lied, mislead us, given us false and wrong information and flat out told us more than once they have been deceptive. They claim to always lose our papers, faxes etc. many, many times. They continue to have our modification cancelled because they say we did not many times provide the information/documents which we have proof we did, certified mail and faxes confirming they received over and over. But they never say this over the phone or tell us they need anything else they send out another letter to say, "Sorry, you've expired you didn't provide us with what we needed again."

We were told not to pay our mortgage payments, so we would qualify but later told they were going to foreclose due to non payments, but we were told this so we would qualify for the modification program. Again, we are trying our 5th time to provide everything they need but they always have an additional excuse or lie of something we did not do, which is untrue. We call in at least once a week even though they say we don't need too. We know they just want to take our home. Its value is way down from what we mortgaged but they want it, we can tell. They are very very difficult to work with. I have cried many many nights just trying to provide them with more and more and more, it's never enough. Then they also say they send us letters or call us. Well, the only letters we received are when they say we didn't provide them with something and they are cancelling us for non-compliance of providing them with documentation in a certain time frame.

We have received one phone call on the modification only because we gave them a phone number no one can miss calls, so they wouldn't have an excuse to say they couldn't reach us like they continually do. They continually say they did not receive faxes 20 to 24 pages even though I fax them over and over and I have confirmation pages. It's always something and no one ever knows what the HARP programs is or is about. Very uninformed staff who don't have a clue what they are doing. Very, very hurtful as a tax payer that at a time when we are barely above losing everything like so many unfortunate others that as we play by the rules and go out of our way to provide everything requested, we are treated so very very poorly. We bailed the banks out of their mess and this is how we are paid back, it just doesn't seem right. It's not as if we are asking for a handout or charity we did not ask for the economy to go downhill, my husband and I have been hard workers throughout our lives and this is the way we are treated at a time when everyone is just trying to survive and help each other to get by. Thank you for your time and consideration.

This all commenced in two days. I have been a customer of Bank of America for eight years. I have two checking accounts and one credit card with this so called America's bank. I have overdraft protecting. I have Mobile banking. I have alerts sent to my email but for some reason all of these features did not protect me from over nine overdraft fees that Bank of America chose to charge me. Even though, I have checked my balance before making these purchases, Bank of America's automated service had advised me of my available funds. Because this automated service they provide, this tells you at that moment what your balance is.

Now this branch and the online service have told me they have been "delayed purchases that have not processed through my account and when they go through, that's when I would get the money deducted out of my account. This in general defeats the very meaning of a debit card. I don't think this is right and this "delayed purchase" is just another reason to charge us, hard working Americans. I was charged a disgusting amount of $350 of overdraft fees.

I just opened this account this month. I am already looking for another bank. I am so frustrated with them, it is unreal. I deposited an unemployment check for $300 which they put a "hold" on $200 of it. When I had to pay a deposit for service for a phone, the transaction went through, but the bank is charging me a NSF fee for it and also for gas that I got, it didn't decline either. They are charging me $70! I wrote to them and told them if the money wasn't there, why did the transactions go through. They said because they have the "option" of paying it for me as a courtesy.

What a crock! They do it so they can get money from me. Yesterday, I deposited another unemployment check for $600. They "held" $500 but since I had only $489 in there, the hold on my $500 makes me overdrawn! I am now -$24.34 in my account. How in the world can that be right? Now, I am sure they are going to charge me another overdraft fee. I write to them and they say they don't see where I was charged a NSF fee!! I wrote back, gave them the dates and haven't heard anything back yet. I believe they are moving the money around in the account to make it look like something didn't clear so they can make money off it.

My son and I were walking our family dog on a Sunday evening along the front sidewalk of their building in White Oak Maryland, when I caught a bright light out the corner of my eye and heard a loud popping noise. I glanced to my left and saw my teen aged son, sort of staring at me and stunned. That is when we realized he had stepped on a live wire from a sign that had been removed years ago.

He had complained right away about a severe headache, dizziness and tasting a burnt "flavor" in his mouth, as well as, smelling a burnt sort of smell in his nose, nausea and blurred vision. He was taken to the ER by his father and they ran all sorts of tests, gave IV fluids, documented the incident and sent him home., referring us to see his medical doctor within 24-48 hours. Since that date (March 2009), my son has suffered from migraines, sleep problems and some memory issues.

His education felt a huge impact with having missed a number of days of school and arriving tardy because of bad sleep or migraines the night before. He is just barely getting by in his studies and regrettably the teachers are not compassionate to the situation at all. When contacting the branch manager for the location advising him of the incident, I was grilled as though I was attacking him personally, called all sorts of names and promptly hung up on.

Last month I called the BOA and asked if they had cameras on the front of the building, because I needed to see tapes for an incident that recently happened, without telling them who I was. The asst. mgr., told me that there are no cameras that face the front, only cameras that observe the ATM and the drive up. This is contrary to what the lawyers for BOA say in their correspondence to my lawyer, saying they have everything on tape and that I am being untruthful.

Keep in mind, within 48 hours of the incident, I took pictures of a contractor digging up the lawn and burying wires etc. along the walkway where the whole thing happened. Needless to say, a suit has been filed and an outcome will be a long time coming, as they will do whatever they can to avoid liability. BOA refuses to accept responsibility for the hazard they created. A healthy vital teenaged boy's life has changed forever and they don't care.

Keep this in mind, all that money and tax payers sacrifices done in the billion dollar bail out bill, and the next time you pay a fee for moving any money or paperwork at Bank of America. BOA being one of the biggest recipients of the billions. Greed drives this banking institution. Medical bills, loss education, dramatic change in lifestyle and altered future plans.

On Saturday, March 20, 2010, I checked my accounts with Bank of America only to find that my secondary checking account was overdrawn by $66.28. As of the morning of Friday, March 19, 2010, my secondary checking account had $5.74. Somehow during that day, Bank of America authorized a check card charge through the debit card linked to this account for $72.02. The pending charge (which will likely be posted to my account within the next couple of business days) has resulted in my account being overdrawn, which itself will incur an overdraft fee on top of the overdraft amount.

When pressed for an explanation, a Bank of America customer service representative gave me at least two different responses, including (1) "Debit cards can be tricky; sometimes they will authorize charges less than $100 even if the funds for such transactions are not available" ; and (2) I authorized the transaction by authorizing the merchant to charge my card. When I inquired if the authorization referred to in the first explanation was due to some back-end protective measure employed by some banking institutions. I was reassured that no such protective measure is present on any of my accounts.

In regard to the second explanation: yes, when I provide my debit card to merchants, I authorized them to charge my card, but Bank of America is responsible for determining if a transaction can be authorized and paid based on how much money is in my account. Furthermore, financial analysts and experts have recently extolled the one significant benefit of debit cards versus other payment methods: debit cards do not allow an individual to spend what he or she does not have, thereby avoiding potentially unmanageable credit card debt and/or exorbitant bank fees. While I have more than enough funds in my other accounts with Bank of America to cover the transaction in question, I am simply appalled that this has even happened. I reminded the representative that Bank of America is one of the institutions that received billions of dollars in tax-payer money to prevent its financial collapse, yet this is how its customers are being repaid. Quite frankly, Bank of America should be ashamed.

In April 2009 I applied for a refinance on my property. After being bounced from "specialist to specialist" I got Richard to complete my paperwork. My payment would go from approximately $1100 to $837 which was great. I paid $495 for an appraisal on the property. After leaving many messages and him not returning my calls, I did finally reach Richard. He said (this burns me up), "Pam, I just got your appraisal back just now and the property is valued too low for a refi.” I was very upset but he said that a program is coming and I should call back in a few weeks.

Well, that turned into several months. I applied to this program and was told that I didn't qualify because of the type of loan I had, but if I call back in a few months yet another program would be available I could qualify for. So I wait several more months. When I finally talked to someone about this program, they tell me that I don’t qualify because I have a PMI! Meanwhile, my payment jumps up again. Over the years my payment was increased from $986 to $1127 per month.

I feel that BOA is a rip off and they have no business in the mortgage business. I have talked to over 20 different "agents" and have probably 12 different telephone numbers and they never know what anything about my issues--either I am calling one department and they have to transfer me to another, etc. Then they won't let you talk to someone in the branches. I can almost understand why given the poor service received. Now, I am experiencing a hardship on the above referenced loan due to a job loss. The mortgage was difficulty to manage even before I was laid off and I have asked on a number of occasions for assistance.

I am in the loan mod program and have a trial payment while they review my information to determine if it can be permanent. I ask, "How long will this take?” They tell me anywhere from 4 months to a year. Up to a year? Yeah, right... I've lost $500. I feel I've been lied to by the "specialists," given the runaround by them and stressed out by the lack of professionalism and training BOA provides their employees. I’ve heard from a couple BOA employees mortgage that they left the company due to some of BOA practices. Don't know if that's true, but I certainly believe it.

I am an independent contractor that was doing a remodel for a client and we wrapped up the job around 12-25-2009. We then called for the final and we have been waiting for now over 100 days for a 15,000 check. I had to take out two loans and have lost over 3500 in charges waiting for this check. I think that Bank of America should be responsible for all my extra fees that I have accrued based on their lack of desire to finish this transaction. I know if I owed them 15,000 actions would have already taken place.

In December 2006, I underwent surgery on my ankle. Unfortunately, the surgery was more intensive than expected. After much consideration, my parents and I decided that it would be best if I took the semester off (keep in mind, I was on crutches for four months, could not drive and so forth). I called Wachovia, my student loan provider, and explained the situation. They assured me that was okay and that the money had not been dispersed to my school. I thought that the situation was under control. Time went on and in May 2007, I received a phone call that in June, my student loans would go into repayment unless I could provide information as to why I was not in school or proof I was actually in school. I sent them my medical records and a mountain of forms. I was told that my loan should go back into deferment. However, that has not happened and every few months I am hounded and threatened. I am a full-time college student with no income until I graduate. I need help.

I want to file a complaint about the frequent overdrafts that occur on my checking account. My complaint is there are enough funds left in the bank at the end of the month and the account still overdrafts. When I first learned of this problem, I contacted Wachovia on February 16, 2010, and I was told that nothing could be done about my problem.

I am receiving social security every month. This is the only income that I have to live on for the entire month, and I cannot afford to pay excessive bank fees. Wachovia has threatened to take over $200.00 in overdraft fees from my checking account, because they claimed that money was not available on the day that I made the purchases. I made the purchases on the same day that I received the check, so I know the money was in the bank.

I spoke with Tonya ** at the Wachovia office located in Charlotte, North Carolina, zip code 28262. I explained to her that I am living on a fixed income and can't afford the expensive overdrafts fees that Wachovia is attaching to my checking account. I have had this problem with Wachovia before where they will continue to pay for purchases even if the money is not in the account. I have asked them not to pay for purchases if there is no money in the account to avoid overdraft fees. They are claiming that I overdrafted in the amount of $200 when I have receipts that the money was in the account and set aside to pay bills.

On February 3, 2010, I withdrew $500.00 from Wachovia and left $141.00 for bill payments. One week later, on February 10, 2010, Wachovia claimed that the account went into overdraft in the amount of $200.00. If this was true, what happened to the $41.00 remaining in the account, because there would still be a balance of $41.00 to cover any overdrafts?

When I spoke with a representative, I was told the funds were on hold for three days and this caused the overdraft. I asked her to go over each purchase with me to explain that when added together, they did not cause the account to go into overdraft. She would not go over the purchases with me and told me she would send me a list. I have receipts of every item that I purchased, and the account could not have gone into overdraft.

I would not let this account go into overdraft, because I cannot afford the $35.00 fees. Something is very wrong, and I am afraid that Wachovia will take $141.00 from my checking account for no reason. Please help me, because this money is all that I have to live on every month. I cannot afford to give Wachovia $141.00 of my social security check to Wachovia. I want one half of the $141.00 Wachovia stole from my checking account and for them to stop holding on to money in my checking account that I use to pay my bills. Thank you.

I pay all my bills via online banking with Bank of America. I had a payment due on the 10th, but if a day late, usually, they do not charge a late fee. I could have paid by check in person but checked the delivery date shown online and it was the 11th so I decided to take the easy way out and pay online. The payment was not received by the 12th and I was then assessed a $30 late fee. In fact, the check was not received until the 13th even though their online delivery date showed the 11th.

When I asked that they honor their guarantee of paying late fees if the payment was not received as promised, they refused saying I chose a date that was actually not a due date but a grace period date. I should be paying my bills earlier, etc. like it is any of their business. They did not deliver as promised and now refuse the late fee because I should have paid it on time and not during a grace period. I have banked there for 23 years but this is the last negative experience I plan to have. They are arrogant, cocky and unethical. Another episode is they changed the monthly savings account statement cycle to 36 days and then tried to charge me $9 because I had 7 transactions rather then the 6 they allow. 36 days! It is very unethical but at least they reversed that error.

On December 17th, 2009, a water pipe burst and caused approximately $45,000.00 in damage to the first floor of my home. Bank of America, my (first) lender required that in order to insure that the work was done, I deposit the insurance funds with them which would be held and disbursed based on the work completed and inspectors they hired to confirm the percentage of work remaining.

My initial disbursement took 3 weeks and many telephone calls with a different story given to me by each representative I spoke with. That Disbursement was roughly $7,800.00 and the check was payable to myself as well as 3 other parties, causing me to then have to have the check endorsed by my equity line lender in 2nd position (located in Ohio) the public advocate firm I hired to represent me with the insurance settlement and my fiancee.

Shortly thereafter, the majority of the work was completed. I reached out to Bank of America requesting an inspection and another disbursement. On March 8th, an inspector (hired by Bank of America) came out to my home and confirmed in a written report to Bank of America, which they acknowledge receiving, that 99% of the work was complete. It has been almost 2 weeks since I made the request for a disbursement to pay the contractor.

Bank of America has advised me that they have disbursed via US Mail $35,000.00, on March 11th. After calling their insurance department, I am again being told a different story about the check from each representative I speak with. Simply, I need this money to remit payment in full to the contractor. For some reason, the BofA is restricting me from the use of my money and will not release it to me. I have about a 50% equity interest in my home and while I appreciate the banks policies, I have respected their rules.

Bank of America is not respecting my obligations. Bank of America has become a hindrance in the process and they are placing me in a position with the Contractor and the Sub Contractors of placing a Mechanic's Lien on my home if payment is not made to them. I cannot seem to get assistance or the truth from anyone within the Property Claims Division at Bank of America. I need someone to advocate on my behalf as a consumer.

They took my money every month for over a year. My SSI check was over $900.00 every month, but I would only get $450.00 to $560.00 a month. I asked a teller why this was happening when I was being careful not to go over my ATM limit, and she told me secretively that it was because the bank held all ATM transactions until the end of the month and then started with the largest and went down the line to the smallest ATM transaction. This inevitably led to an overdraft before it got to the small ones because you never knew for sure how much money was in your account. The amount that they tell you is in your account is never accurate. So of course, all the bottom smaller ATM transactions were charged $35.00 each. Many for $2 or $3 transactions.

Bank of America robbed me in my face and did not even use a gun. I want my money back. How dare they switch banking as we have known it for centuries around for their selfish greedy thievery. That is exactly what it is- Thievery and they should be held responsible. The parties who concocted this thievery go to jail as any common thief, have all their assets taken away from them, live on parole with no money or job when they get out and see how it feels to be poor and have your food money stolen by the bank you trusted to keep your money safe. Also most definitely BOA must return all the stolen money back to the people that they stole it from. They are nothing but thugs and thieves and should go out of business paying for their unforgivable crimes.

I am 53 years old with an extreme heart condition and because of Bank of America could not afford utilities and food. My life was already sad enough. Try explaining to God why you stole the poor peoples pittance for your greed. I used to dream about a glass of cool-aid. I could not even dream of eating food by the end of the month- just a drink of cool-aid or a Dr. Pepper. I consulted SSI and was enrolled in their direct deposit mastercard which cannot go over its limit. I had begged bank of thieves to not let my ATM go over its limit. They told me it was impossible to stop it when the money was gone because of electronic banking. Malarkey! If I tried to withdraw $20 out an ATM machine, it sure stopped me! Banks are crooks! Hold them accountable for their thievery and robbery or the public will be up in arms and take care of it for us!

Why did we bail them out? After many calls and a trip to the branch and holding long time, I don't have info I need.

I have a legal agreement with B of A to take my mortgage payment out of my bank account on a bi-monthly at the rate of $1620 (taken on on the 3rd and 15th of each month). On 2/9/10, Bank of America randomly withdrew an additional $2839.39 in addition to my regular mortgage payments. I have called, emailed, written, faxed and been passed from one rude customer service rep to inept supervisors for 1 month now and I still have not received a refund of these illegally taken funds. I am not allowed to talk to anyone in their payment refund department as no on at B of A has their phone number. Since B of A took an additional $2839.29 out of my account, I have been assessed overdraft bank fees and bounced check charges as well as interest.

I had some unauthorized transactions on my checking accounts due to an online loan I applied for. I made the bank aware that somehow other companies beside the loan company I applied for were taking money electronically from my account. They filed a claim but I keep getting charges from different companies and the bank keeps charging me overdraft charges and they refuse to close my account until there is nothing pending.

I explained to them that as soon as one transaction posts, another comes in and once again, I am unable to close my account because of the new pending transaction. I asked them to stop all transactions from coming in but they refuse to do so because as long as my account isn't a zero balance, they can not freeze my account. So, they claim they cant' stop anything from coming in to my account. Meanwhile, I am being hit with unauthorized transactions plus overdraft fees that I can not cover because as soon as I cover one transaction, another ones come through. All I want is to close my account or change my account number but they claim they can't do that until there are no pending items on my account, but there are pending items almost everyday and I am unable to close my account once again. I am the customer and if I want any transaction to be rejected, I should have the right. After all, it is my hard-earned money that they are taking. I just want the bank to be more helpful instead of having to file a claim after claim.

I have a loan for my 2005 Ford F150 through Wachovia Dealer Services. As my wife is unemployed and we are facing hard financial times, the company stated above has been harassing and unwilling to work with me in a professional manner. To start ,since the beginning of this loan, the company starts making calls for payment up to 15 days prior to the due date. I have had to change my cell phone and my wife's cell phone number because of this and have recently refused to give my now new house number.

They consistently call me at my place of employment and the most disturbing act was just received yesterday, March 11, 2010. My employer received a bill addressed to them for my loan. My loan is a personal loan and there is no co-signer. The bill did not say c/o Kevin so it was opened by accounts receivable and needless to say, very inappropriate and unprofessional. The loan amount due the 28th of every month is $424.33. I have not had a very strong payment history with on time payments but have always made payment and paid all late fees.

Currently, I owe a past due amount of approximately $250 with the current month's bill amount of $424.33 due on the 28th of March. I have tried to contact the company along with my wife to set up a full amount payment of both past due and current due for the 25th of March and as customer services says that is okay and they will note the account. I am always then transferred to the billing department and they refuse that payment saying I owe it now and harshly threaten and harass.

I got cheated by the Bank of America. My online balance showed that I had a positive balance, and that is how I go about spending. When I saw that I had a positive balance in my account, I went about my usual spending. At the end of the day, I had a positive balance of about $10. The next day, I opened my account and saw that I had a negative balance of $200. And it was caused because of four overdraft fees of $35 each.

I called them up and filed a claim and they reversed three out of the four overdraft fees. That same day, I went and deposited $800 in my account. The next day, I see that there are four more overdraft fees there even though I have a positive balance. Their explanation is that some transactions didn't post to my account earlier and that is why those overdraft fees are there. So in total, there are five overdraft fees related to my account even though I have a positive balance.

My complaint is that why weren't those transactions that caused my overdraft shown in the pending section of my account before? And how am I supposed to know that there is a negative balance if it doesn't show on my online account? They have all kinds of explanations for the overdrafts. But I have been cheated off a lot of money for what I believe is their fault. If I have overdrawn firstly, my card should not have been approved for further transactions. Secondly, if there were any pending transactions, they should have shown in my pending section of my account. Because of this, I have been charged over $170 in overdraft fees for something that was not my fault.

Why do they have the online account feature if it is not accurate? They should at least warn the customer beforehand that the online account is not accurate. I was not made aware of any such mishaps. I don't know what to do now. I'm broke and no money to eat.

I was visiting my friend in San Jose, California. I had too much cash, so I decided to make a deposit at Bank of America. At the counter I took out my envelop of cash and counted 2,700.00 and placed the money onto the counter. I told the teller that I need to make a deposit and I'm from out of state. He took the cash and put into the money counting machine. I even asked him " this 2,700.00 will be deposited right away, right?". He answered, "yes it will be deposited right away".

He tried a couple of times to make the deposit, but he couldn't get into my account because it was an out of state deposit. So he calls the manager over to authorize his transaction. He finished the transaction, which I even confirmed with him the second time before he gave me the receipt. When he handed me the receipt, I didn't remember checking the amount on it. I just remembered looking at it real quick and put the receipt in my wallet. When I returned to Seattle the next day, I logged on to my online banking account and it showed that I made the deposit in the amount of only 700.00 dollars. I got really scared and started looking for the receipt that when I had realized the amount on the receipt was 700.00 dollars.

In tears, I ran to the Bank of America in South Center Mall asking for help. Rachelle helped me contact the bank manager over in San Jose. They told Rachelle that they remember exactly who I am and that the teller said I only made 700.00 deposit. To me that is impossible to remember a client after a couple of days. Rachelle and I requested a review of the video, after 3 weeks of waiting. Today I received a phone call saying that it doesn't look like I made a deposit of 2700.00 dollar. I asked her how come you didn't look at the angle of the screen where the amount was shown when the machine counted it. She said they didn't have that angle.

I asked her, "You said you saw me counting the money. Why didn't you zoom in and look at my hand movement when I was counting the money. 2700.00 is a big difference from counting 700.00". She couldn't answer that question. Now I'm currently waiting for them to transfer the video over so Rachelle can review it. I really need your help. 2000.00 dollars is a lot of money to me. I only make a thousand a month, i cantnot afford to lose that money. I have no one else to turn to.

Our good credit is damaged and we get calls and letters telling us intent to accelerate? We made the payments and on time. We have proven we made them.

They mentioned a MRC program had helped miss up things; we never heard of it and do not know what they are talking about, just that it sounds like it messed up maybe up to 150 people's payments together. As of the last 5 days, they will not respond at all. They will not answer emails or return calls. I have dealt with over 27 people with this issue, still no help. Back in 2005, through "bill pay", Wachovia's online bill payment facility, I instructed a check payment to my accountants (at the time) for $4,296.49. This was for them to settle a penalty tax notice on my behalf. The debit clearly shows on my bank statement on 10/13/2005. In Sept '07, my new accountants (I had since moved my tax affairs) received a penalty on the penalty which suggested that the initial one had never been settled.

At that point, I started to make inquiries and my former accountants stated that they never received the original check, hence, never paid the original penalty. I then approached Wachovia for proof that the check had been cashed, as the amount had never been refunded to me. Despite several demands, all Wachovia would say was that they were using a different bill pay vendor in 2005 and could not produce a copy of the check. I then approached them to request that, at the very least, they refund the original debit to me. This request has been totally ignored to date. I feel treated very unfairly and I am determined not to give up!

After years of pursuing the matter, I am still out of the original $4,296.49 and a further $5,534.88 which I had to pay in 2008 to settle the outstanding penalty plus charges etc. It's hard to quantify the anger, frustration, disappointment that I felt and endured these past years over this issue. I am sure that, at times, this has affected my physical health and well being too and has wasted a lot of my time which should have been better spent.

In the meantime, Wachovia did absolutely nothing to help! They instead added fees for debits that were used prior to the garnishment, yet any checks that were written prior to the garnishment were returned stating account frozen, with no fees attached. I called every person I could speak with at Wachovia, even spoke with managers at the branch. They received legal documents to freeze the account on 2/23/2010.

It only took them 12 hours to freeze my account. When they received the legal documents that the freeze was reversed from the attorney that requested the freeze, all I got was it will take 48 - 72 hours! Funny, how quickly they froze the account but not willing to react as quickly to reverse the account. On top of that, I have received three phones calls a day to pay for the fees since it showed my account was in the negative, even though I kept telling them this was going to be reversed. I continued to get calls to pay for the fees. At one point, I was told, "Well, I will note that you refuse to pay for these fees."

Wachovia still sent us mail, etc, as if we still owned the house and until it was foreclosed on they still considered us owners. We received several mailings from them. This included doing a short sale.

Our realtor, Sue S, was working with us and trying to work with Wachovia to get an offer on the house. We had two offers that were submitted. They never negotiated with us on the first offer and in fact when the realtor called to follow up with them, they always had an answer as to why they could not respond. Something was always missing from the paperwork that was turned in to them or Sue did not have permission to negotiate. This was established immediately with her. So the second offer came across two days ago and this was also faxed to them. Our date of foreclosure was March 3, 2010. They never planned to negotiate with us and went ahead and bought out the property from under us and those who wanted to buy it.

This has been a grueling process. We filed and settled in September of '08. I think it was and ever since then, we have had nothing but trouble since. Even our attorney was a ***. I'm so fed up with bureaucracy crap and the big guy taking advantage of the little guy. What about us? We get no help or guidance even our Chapter 7 I had to do and guess some of it, we were lied to and not told stuff we should have been told. I thought once you file on your house that there is no more negotiating and then when we did try because we thought it was the proper thing to do to save something about our credit, we get screwed as always.

I had been paying over $800.00 for all three accounts and still couldn't keep up with payments. They offered to do a debt reorganization in which now, in addition to my mortgage, they are taking out $680.00 for the three accounts and my mortgage is $1013. I have asked about reducing either the payments or mortgage and was told, no with accounts.

I am trying to contact the mortgage division to see about reducing that amount. On top of all of that, I had used their automatic payment deduction and have had not one, two, three but four times payments taken out, leaving me with a negative balance in my checking account. Even after writing to them, email of which I have always have up to this past year and gotten a response within 48 hours; this time, there was no response. I have taken my mortgage off of the automatic payment but the other accounts are still there. There have been months in which I have had $50.00 to last through the month and I haven't even gotten groceries. I make certain that house, insurances, utilities are paid first and have always made certain that accounts have been paid but now, it is a struggle to get other accounts paid.

I will not do bankruptcy and that is just not an option. I need some other options particularly if the three accounts can be reduced. I can manage with the others. I also have student loans from graduate school that I am completing this May, plus, one from 30 years ago that I paid off the earlier ones from that time. I am using a car title place because at the middle of the month, I have little or nothing and still have bills to pay. That is not something I wish to do either! My car has been paid off for years! Also, I have emergency room bill, that thank goodness is not over a thousand but still at over $400. I have to make payments of $60 to keep from going into any collections!

I have contacted an attorney this morning and as stated earlier, I simply will not lose my home!

This is ongoing back as far as 2000 to date. My checking accounts, a total of 4 at that time, month after month did not come out right with my balance in check books. As it always came up short to my balances, the funny thing is I took accounting in school and my adding machine is correctly adding and subtracting. Yes we are retired on a limited income as 3 accounts were inherited from my mother passing away as the three accounts all of the time were short in money even when my mother was alive as she knew how to add and subtract in her head but to double check, she used a adding machine also to check balances of her accounts. The only accounts that were correct was her CDs and her accounts were always keep up to date.

After she passed away, I got them all but always a problem with them coming up short as their balances was not the same as mine but continued to use them. But when checking out the statements that were mailed to me, they were perfect but always were short from and 2.00 to $5.00 per month short or more or give or take. Then after closing out the accounts, 3 of them and closing out the CDs, we had 1 account with them and it even came up short on money after confronting them and asking why? There were short every month. I was informed that it would cost me per hour to audit my account being cheap as I am. I said no way but was informed they did not make mistakes it had to be me. So we started keeping tally of the amounts shorted monthly as it came up to a lot of money over a year.

So my wife and myself had built up a nice surplus of money as we wrote a check for an amount to get dog food and guess what, we could not get that amount of money from our account. We had to put back into the account X # of dollars to keep them from an over draft fee. At this time, we decided to change banks as I had a personal account with another bank and it checked out dollar for dollar every month for about a year and a half. So we changed to another bank and for the last few months, it came out perfect dollar for dollar.

As we made arrangements with this bank for direct deposit of our checks, then this month without notice they started charging a service fee for a free account as their website so states but in the small print just added there is a fee when no deposits are made by direct deposit. Now I am being charged for this open account not being used as it has been only one month no activity. Now I owe them about $9.00 service fee but was told by Social Security to keep this account open for any errors so they could make sure it was deposited in my new account. As this is the facts I owe them after years of them taking my money from me and my wife. So guess what, it will be closed as of today 03/02/2010 and I will never recommend BOA to anybody. I am through with them and won't go back after them after getting taken for 100s of dollars over the last 10+ years.

One month we got behind and received a call and I explain to the rep, Nicole, that she was out of town and I was without a job but not to worry, I will make the payment which I did. For the last 3 months, I made payments, but they were late, less than 30 days for sure. I e-mailed Wachovia about these charges and they responded saying that they initiated an investigation and the charges would either be refunded based on the results of the investigation, or they would at least temporarily refund them if they did not have a resolution to the issue within 10 business days.

Ten business days passed and a debt collector kept calling multiple times each day. I am a resident physician working crazy hours and can't be distracted by these harassing calls. I asked in the original email for a payment plan if they were not going to reverse the unfair charges because I'm on a resident salary and cannot afford it. That request was never addressed. When I called to speak to the Bank of America phone representative, they tell me they can only go a year back and that they show I've never had overdraft protection. I know I have had this in the past and ask them to go back further than 11 months in my history which they say they cannot do. Bank of America steals from their customers. They create overdraft fees by not processing your purchases as they occur even though you have the money available and at the time of purchase they went through fine. If you look at your balance, you will see the "Balance" and "Available Balance" and will notice the amount you just spent is now gone from the "Available Balance". So this means they have removed the money you just spent for the purchase you just made. Only problem is they don't actually clear your purchase even though they have removed the amount from your "Available Balance".

Instead of clearing payments they hold them, sometimes for several days, and they call them "pending transactions". Then they wait for other higher charges to come through. When this happens, they will clear those higher charges and then process the lower charges, and often times, this creates a deficit and will overdraft your account. If you have money in other accounts or a savings account, they will freeze those accounts and not allow you to use or withdraw any of it unless you use it to pay their fees and get the negative account into the positive. So you could find yourself with an unexpected negative balance and be frozen out of your accounts unable to get any of your money.

Right now we are in the middle of this nightmare, which we have seen several times since opening up accounts in 2005 and 2007. We were paid on Friday, January 29, 2010. We had plenty of money in the bank and that day, the 29th, I paid several bills and then that weekend we bought groceries, and made several small purchases. Our account online looked in order and the "Balance" and "Available Balance" were correct because all the purchases we made were now gone from the "Balance" and showed what was left in the "Available Balance", which was in the positive. When Monday, February 1, 2010, came, I planned to deposit more money into the account to cover two car payments that were going to be coming out that day.

When I went to check the online balance, I saw that they had cleared the two car payments, which were supposed to clear Monday, and they used the money that had already been reserved (or so I thought) from the payments and purchases we made on Friday, Saturday, and Sunday. Then they proceeded to overdraft five of those purchases at $35.00 each. Later, in addition to that, they added another $35.00 fee called an "Extended Overdrawn Balance Charge" because the account had been in the negative for 5 consecutive business days.

We would love to close our remaining account and leave, but we are stuck there. Because of one of the many times they put my account into the negative with overdraft fees and it snowballed from being a manageable amount to an unmanageable amount, I was unable to get caught up. Then they started to charge me an additional $35.00 for "Excessive Overdrawn Fees" when my account was in the negative for 5 consecutive days or more. Soon I was unable to ever get caught up and pay my rent and bills and buy food and gas. I had to stop depositing money into the account because it was just getting eaten up by their fees and I needed to pay for basic necessities and rent. They eventually closed my account and then reported me to Chex Systems.

Now because of this I am unable to open another bank account anywhere and am a prisoner there, unless I want to have no bank account at all, but then how do you cash your checks and pay bills like a normal person? You can't without a great deal of hassle and the danger of having cash in your possession, which is risky and unprotected. But really, what's the difference? It can be stolen by some random thief or it will be stolen by the bank you are supposed to trust to keep your money. Not rob you blind.

My story is just one of many exactly the same and this issue with the banks using computer programs to overdraft their customers’ accounts has to stop. They have literally stolen hundreds and hundreds if not thousands of dollars from my family. They refuse to refund the money and they continue to practice this fraudulent scheme year after year to hundreds of people without consequence. The Internet is loaded with stories exactly like mine. I have been talking to people at stores and other places of business and have heard the same story from many of them about Bank of America and a few other banks that are doing the same thing to their customers.

These banks squandered billions of dollars away on who knows what and then needed to be bailed out by the government. They created the sub-prime lending schemes to make money and we all see how that turned out. Now the country is in turmoil and the economy is in the gutter and people are suffering because of it. Now they add insult to injury and steal from their customers by creating this overdraft charge theft scheme to make money. Why is this legal?

On November 2nd, my sister electronically transferred 100.00 into my Bank of America account to help me attend the funeral. On Nov. 4, she transferred another 100.00, so I could get back home.

Unknown to me, the money was transferred from my mother's bank account. The Social Security Administration notified the bank of the death date and instructed them to return any funds deposited after her death date. I did not have access to my mother's account. On Jan. 22nd, the bank reached in and took the balance in my account which was less than 30.00. I did not receive written notification of this until Feb. 4 and the letter, although supposedly generated on the 22nd, was not postmarked until the 26th.

On Jan. 25th, the first day the bank was open to find out why there was a hold on my account, I spoke with Alisha at the reclamation department and she explained why the money was taken. She told me that I was liable for the $200 that I benefited from my mother's social security. She assured me that no additional funds would be taken until after this amount was submitted to the Social Security Administration and they returned another request.

She also advised me that although I was liable for the total amount of $200, but that they would work out payment arrangements with me when they heard back from the Social Security Administration, which would be 60 - 90 days and she stated we aren't that mean. I advised my sister, who is the executor of my mother's estate and the only person with access to her account, of the situation. She contacted the Social Security Administration and was advised that they had no information and to contact them when they received the money taken from my account and they would make arrangements with her to repay the rest.

On Feb. 4th, I received their letter, called the bank, and spoke with Talit. She advised me that they had no choice but to take the money, but again I was promised that no additional funds would be taken - yet. On February 5th, the bank took $200 out of my account, thus reversing the promise made to me by two both Alisha and Talit. They both lied to me.

Also, the first $100 was transferred before the direct deposit made on Nov. 3rd, so it was not a part of the deposits referenced in their letter to me. Talit advised me that it didn't matter because the transfer was made after her death date, which is not what the letter indicated. This is just plain wrong. They reached into my account and took my funds with no notice. I was not notified of this issue by the bank until after the fact. They did not allow any opportunity to work out the matter with the Social Security Administration or with the bank.

They broke the promises made to me by two of their customer service representatives. They held me responsible for funds that I had no access to other than what was transferred by my sister for the express purpose of making it possible for me to attend the funeral. I was not aware of where those funds came from, nor was they any reason for me to question it.

They took my rent funds, pushing me to the edge of homelessness. I had to ask for help from my church and take a distribution from my 401K, incurring penalties. I lived in constant fear that they would take even more money to cover funds that they said my sister is responsible for. I closed my account and took my name off the joint account with my husband so that the bank has no access to my money. Closing accounts and changing banks is a tremendous inconvenience, but my financial safety was at risk with Bank of America.

Bank of America charged me $140 in overdraft fees when a pending transaction appeared two days in a row. I have savings overdraft protection, which was also triggered, and it covered the problem that appeared on my online statement. When I asked the first representative I talked to why both savings overdraft protection and overdraft fees were triggered, she said that was a good question and that it shouldn't have happened. And she said that if I called the next day when the fees had cleared, I would receive the fees back.

When I called the following day, I was told a different story. I talked to three different representatives who all said that the fees were my fault, that even though overdraft protection had kicked in, the computer that handles overdraft protection hadn't recognized the larger amount of overdraft created by the pending fee taken out twice and that no one in the bank would refund the fees for me, regardless of what the first representative had told me.

I then became very serious and told them that my husband, an associate of Bank of America, was encouraging me to take my accounts to another bank, because these dealings were unethical. I asked if this amount of $140 in overdraft fees was worth losing a customer who had been with the bank since 2002.

The final representative I talked to, Desiree **, assured me that the bank would rather take the loss of my business than refund the fees. I asked her if she was prepared for me to make this situation public by contacting Consumer Watchdog and the Better Business Bureau, she answered with a weaker "Yeah..." I then said, "I'm sorry that the bottom line was more important than maintaining customer satisfaction," and ended the phone call.

As soon as all transactions clear, I will be taking all five of my accounts to a competing bank. The $140 that was taken from our account will prevent us from buying groceries and other necessities for the rest of the month.

I have at least 2 to 3 deposits coming in. Today, I got my income taxes, and took it over there to en-cash. It was in my married name, and my account is in my maiden name, which I had ID for both. They are saying I have to deposit the check into the bank, and withdraw in a few days, because of the name, which I thought was wrong. They know me well. Every time I go in there, they ask me the same thing, and I show them the same thing every to week.

There were customs in there, and the cashier was very rude. It doesn't matter. They are just rude. They know me by name. I also have overdraft protection, and I get overdraft, but I get charged time after time, instead of getting it out of the other account. Why am I saying so much more? Something needs to be done about their rudeness. As I was walking out, this lady stopped me, and told me that she was looking 4 another bank, because of their rudeness.

Everyone knows a valid check can clear in 1-2 days and if you make purchases on that deposit, you are charged $35 and they hold onto charges until they can charge you $35. This bank was bailed out by the US government. They are unethical and not customer oriented at all. If you have an account with them, or credit card, bail out now! I had multiple $35 charges that were not valid. They increased in interest rates on credit cards regardless of your payment history and held deposits for 10 days or more without valid reason. The most unethical bank I have encountered. Close them down.

I am an employee of BoA and it seems that it is a game for BoA to see how much money they can take from my account. For instance, I receive notification via text that to avoid an insufficient fee, I must bring account current. I immediately went to the bank to make the deposit in person. Later that day, I received a text saying I have been assessed four insufficient fees for the transactions. The agent told me that this is for the extended overdrawn balance as if I was not to pay it. I stated to the agent that "so by me paying to bring my account current, I am agreeing to BoA for the micro loan they could charge me". I was charged $35 per transaction for 4 transactions. That was my birthday money.

Bank of America in my husband's word is the devil. I cannot decide if Bank of America knowingly sucks you in by offering superior customer service, which no one wants to help you and many locations to make it easy. Bank of America is the hardest to get any credit with and they will take money from the people who don't have it. The overdraft was a total of $41, I was charged $140. This is why people don't want to use banks and keep them in the mattress. As an employee, they have continued to make you work harder for less compensation with less appreciation. I took a Leave of Absence last year and that was the worst experience. I have worked for this company for almost 5 years. It is not like I decided to just take off.

I do know that is not BoA's decision regarding my approval of paid leave, however, towards the end of the year at Christmas, I received 2 letters: One from BoA saying that I owed for Sept/Oct/Dec. If I do not pay, I would permanently terminate my insurance on Dec. 31st. They gave me 2 options, take half from my 2 paychecks in Dec 2009. The 2nd letter was from BoA/Fidelity stating that because AETNA did not inform BoA/Fidelity that my pay on leave was not paid, I was subsequently paid for 80 hours of time. It was a very difficult time for me and when I saw that, I thought I was approved. My husband doesn't work because he watches our toddler and I work to pay my child support and his. I am negative every month. Not your problem, I understand.

This is what the agent Aaron said, "please note that if the account is overdrawn by ten transactions in a day, only four fees will be assessed". Previously, ten fees were being assessed for overdrawing the account by ten transactions. It has been reduced to four fees in a day. Wow, that's nice. I know that this is just another letter I'm sure other people have voiced their opinion about, but this has happened too many times to count. The last person I talked to about this said if I make the deposit by COB, then it won't charge. Well how can I go back in time and why would I receive that text after the fact? Nothing matches and it is very sloppy and makes BoA look very bad. Even a response to say sorry for you would be nice. Who knows? Maybe they will fire me because of this.

Bank of America has been stealing my money at $35 a pop since 2004. My husband and I have been having financial difficulties since 2004. When I make a purchase, I always use my debit card, and enter my pin. Bank of America treats these like a credit transaction, and does not take the money out immediately as they should. Not really knowing this and thinking my purchases are okay, I will continue to buy food or whatever is needed. Then they take those transactions and pull them out of my account all at once on a completely different day, sometimes 3 days later. This then puts me in the negative and the fees of $35 snowball into hundreds a month. This is a consistent problem.

By now they have probably stolen thousands from us. Then in December 2009, I saw that for 8 months someone was taking $39.95 out of my checking account. I immediately called Bank of America and they opened a claim and promptly reimbursed me the $319.50 plus the $1,750.00 in overdraft fees this had caused. On February 16, 2010, I received a letter from Bank of America stating that my dispute falls outside of the time frame they have. They are going to be taking back the credit of $2,069.60, which I do not have.

I made a purchase on Monday, 2/15/2010, using my pin number. I stopped at a MAC machine and took money out on the same day. There were also purchases for gas and other purchases made over the weekend. All of this came out of my account today and now I am in the negative. Now the fees will build up again. This is an unfair business practice. When you purchase anything using your pin, that should come out immediately. My husband and would not make these purchases if we had no money in the account. the emotional toll of having financial difficulties aside due to all the excessive fees, there have been many times when I could not purchase food, gas for my car, or even order my son’s graduation pictures.

Economically, it is hard when you are always in the negative. They have to get their money first which makes it difficult for me to pay the bills when hundreds are taken right off the top. I feel like they take advantage of my financial hardship because without checking my balance, and sometimes just going by the fact that I checked my balance the day before. I know I have money in the account, and I am able to pick up my son’s prescription only to find out that I was in the negative. I did not know they allow the charge to go through and I am right back to $35 per item again.

I'm not to good at this. I am a 36 year old paraplegic relying on my SSI income. I have noticed that on a quite a few of occasions, BoA has charged me $35 for each over draft and for not paying that balance within five days an additional $35 is added. I'm not saying that I do not overdraft. Times are hard and bills food etc.

I need to live but when BoA charges me-- example, I had a balance of X amount of $, made two debit/credit purchases knowing I had enough to cover those items, then after I made one last purchase (that I knew would be an overdraft) so I would be able to cover that one overdraft on my next check.

I went to my account online and noticed i had three overdrafts on my account which surprised me. I gave them a call to find out what the problem was and was told that they take out the highest purchase first and then they do the smaller ones. I explained to them that my smaller purchases were done three days prior to the bigger one and I would think they would cover them in the order they are done since I had enough funds to cover the smaller ones. They told me that that's not the way they do it. I tried to argue the point but got nowhere.

I feel this is very unfair being that since they did it like that I incurred three overdrafts instead of only one which put me behind. Now I'm still trying to catch up. I feel they do it this way knowing that it will cause more overdrafts and they collect more money. I'm paying for overdrafts that they made happen on my account because they put the larger amount through which made my smaller amounts that were covered turn into overdrafts also. $105.00 total which I wasn't expecting and set me back for three months and wasn't able to pay my utility bills.

I have paid hundreds in overdraft fees that were unjust. There have been times that I have even found too many overdraft fees and they had to remove them stating it was their mistake.

Now after still putting up with, I went to my bank and deposited my income tax check in my account. I was told that there is a hold on my account and that I can't get any money out until the check can be verified. I had customer service tell me that some money would be released the next day until it could be released, but the next day, no money at all. The customer service when I called was pretty rude. I have been trying to modify my mortgage. I started in September of 2008. I applied for "The Hope Program". I filled out the application number 1 and waited. I was finally notified that I had documents missing on December 3rd and the file would be closed if documents were not received within 3 days. I called and told them that I had just received the notice and was given 3 days to respond, but that I would overnight the information and asked that they call me if it was not received. I had not heard by the end on December, so I called. I was told that the documents were not received and the file was closed and that I would have to re-file.

So January 2009, I re-filed application number 2, sending all of the same documents again. I called and checked periodically and was told that all was well. Finally, on a call I placed during February, I was notified that the file had been closed and that "The Hope Program" was no longer in effect. At this time I called the first person that I had contacted and he told me that it was "too bad" that this had happened because I had been on the top of the list for "The Hope Program". He also told me at that time not to apply for a regular refinance because I would be turned down. He advised me to wait for the upcoming modification program from the government. He told me that someone would call and try to have me refile for a regular mortgage but to tell them "no," that it was a waste of time and that I was waiting for the modification program.

Sure enough someone did call me from Wachovia to apply for a mortgage. When I explained to them that I was waiting for the government program, I was told that they were not sure that there would even be a program, and they could help us out in the meantime--so what would it hurt to apply? So I capitulated and sent in application number 3.

A month later (yes, I was still calling frequently to make sure all was well with the application and was being reassured that it was), I received a denial letter stating that our income and debt ratio would not allow for a refinance. I called them every week after that and was told that Wachovia was not set up as yet for the modification program. In May I was told that they had another type of program that might help us. I needed to reapply and they would offer me a new package. I had three chances to accept it and if I didn't then the offer would be withdrawn. Application number 4 was sent. In June an offer was received $300.00 more a month than we were paying. I called them and asked them if they had understood that because my husband was injured at work and no longer allowed to work and my income had dropped and how did they think that this offer would help.

In June, I heard that the modification program was starting at the banks. I called and was told it was only for the people who were in foreclosure, but they would put me on the list for the modification program. I continued to call every week to check and see if I was still on the list. And finally, at the end of August 2009, we were told we could apply. We fit all the requirements--change in work status, predatory loan, etc.--so I sent in application number 5 on around September 16th, 2009. I called every 3 days for status update. In October they told me that all of the documentation wasn't there. October paystubs were not there. I told them I applied in September and my file was complete for then. However, I faxed them the information they needed. I kept calling and checking. Still nothing.

Knowing my husband would soon be settling with workers comp for a lump sum, I waited and called and told them I would be refiling. I refiled application number 6 on December 6th. I checked every couple of days. On December 11th I was told the copy of our federal income tax was not signed, so I faxed them a signed copy. I continued to call every few days and was told that everything was fine. It was the end of December 2009 that I was told that they were missing a wage statement for worker's compensation. I told them that my husband was not receiving weekly compensation and there was a court document enclosed showing our lump sum settlement.

They looked through the file and found it and noted the file with the page number. The next several times I called, I was again told I was missing the wage statement for worker's compensation. Each time I explained, and each time they found the document and noted it. Finally, on January 5th, 2010, after being told I was still missing the wage statement, I lost it and asked to speak to a manager. I spoke to manager Janssen W. She said she would rectify the situation--documenting the file complete and sending it to the underwriters. I should hear within 30 days. I have called at least weekly since then, each time confirming that the application was with the underwriters.

It is February 12, 2010 today. I just got off the phone again. I complained that it has been over 30 days and legally isn't there a time limit to their response. I was told by Joshua P. that it is still in the incomplete stage as far as he can see and it might help get the process going if I were to send something in writing saying that we are no longer receiving weekly wage from workers’ comp and that the copy of the court statement for the lump sum settlement is already included in the application. I told him it was my fear that to do this might trigger them to say that this process has been too long and I need to submit a whole new application. He then put me on hold and spoke to his manager Rebecca H. She also thought this might be the only solution, so I will do this.

I have owned this home since 1980. I refinanced for court ordered college tuition for my husband's daughter. The loan started at $200,000 and now is up to $220,000. We have used all our credit cards to pay our mortgage. Now we are out of credit. We are now using the lump sum settlement and what was supposed to last until my husband's seventies is half gone. I was asked this question several times, but I was certain I had made the payment on Jan. 5th and wanted to check into the matter first.

The consequences were the $39.00 late fee and a black mark on my 10-year record of payments made on time. It is not so much the amount of money involved as it is about the principle of the matter. Today, for the sixth or seventh time in less than two years, my bank (Wacovia) has charged an enormous amount for overdraft fees. I was overdrawn by $12.56, the result of an online purchase for $13.95. I had made a $20.00 mistake in my bank book, so fair is fair, I owe them $35.00. However, when I called the toll-free number today to get my balance, I had been charged $105 in fees!

I was told that they hold all charges to my account until all for the day have been cleared then they process them in order of largest amount to smallest amount. The smallest on my account were three for over $5 each. Well, by doing this instead of processing the way I had always believed they were being, which would be in order of time of purchase. This way they are assured to get the largest amount in fees possible.

I have fought Wacovia each and every time on this, won some and lost some. Once, I even had to show a bank receipt because they had proof that a cash deposit was made after 2:00 P.M., when my receipt showed that the deposit was at 1:36 P.M., when I made it. Now this junk about in order of amount is causing more consumers than just me to be overdrawn more than just one fee. I have even had to prove that I wasn't overdrawn before when charged fees! The bank has doubled purchases, doubled atm withdrawals, anything they can do to take money from my or anyone else's account. Is there anything that can be done to stop this?

I have lost more than $1000 to Wacovia over the past two years from these fees. I could not change banks until this week because my direct deposits come at such different times that I had to wait until now for the deposits to be lined-up perfectly to get the deposits changed to another bank in time to get the letters to the depositors in time.

As for economic and physical damage, I am out the amount of money mentioned above. I am currently out $70.00 more than I should have been charged, which means that I will not be able to buy groceries this week. My husband has been laid-off from his job in construction for over a year, and has not been able to find work. We also have custody of our 4-year-old grandson (since he was 1-year-old), so we at least have to feed him and have a little something everyday ourselves! These tactics by Wacovia has put us behind on other bills, making me have to pay late fees on the other bills.

And as far as physical, I have high-blood pressure which goes through the roof when this happens, plus I have to take a medication for anxiety more often when I am having to go head-to-head with these money-grabbing, greedy people. It's not the clerks or folks on the phone because they have nothing to do with it; just the executives who make rules like this to make sure they get big bonuses!

Where do I start? My ex husband 5 years ago, wrote a bunch of bad checks. I had to pay them off and reopen account. But when I get a loan or whatever or change banks now, I have to have a letter from a bank employee (that took the money) that I did pay it. They say, they cannot fix their records saying that I did pay that money but do not worry, they will keep writing letters in my favor. I am reporting them if they don't fix this computer error.

A few months ago, they paid an online bill 5 days before set date, before I revived my paycheck, had me bouncing and on the phone with my car company all day. They should have called, they did fix that screw up. July 2009, they paid 2 bills of mine 2x in one week.I called both bill collectors and explaining to them the bank paid them 2x. They refunded the extra payment. But...

I went to Bank of America to get the over draft fees taken off. The vice president told me I should have not went to Walmart to get groceries or pay my child's daycare. Knowing I did not have the money, um! I would had the money if they did not pay 2x on my bills. It took a week for me to get my money back, I had to buy groceries and put gas in my car and she had no concern and talked to me like I was a idiot. She only return some of the overdraft fees. She said, it wasn't the banks fault that I paid bills after knowing there was no money. Again, the money would have been in the account if my car and phone payment was not posted twice in one week.

Then the other day my husband gets paid, for some reason this time it took 2 days to clear. I bought groceries the day he was paid, I paid bills the next day.Well, the bills cleared before the check did. He has direct deposit, went in at 2:30 am and I did not by groceries until 4 PM that day, the check was way in before the bills and my shopping trip. They told us " We understand these overdraft fees are "something" but we cannot refund you the money".

Wait! The money was in there, and she just kept repeating herself. We now owe Bank of America $460.00. My husband gets paid in 2 days and our tax refund comes in also. So, I finally get to eat something besides Ramen Noodles. 2 weeks with no money, cause of them holding his check for 2 days and the overdraft fees left us with nothing but debt. Oh wait, his check won't clear for another 2 days, so it will be 4 days before we get some real groceries in our stomachs. We are closing our account when we pay those ridiculous overdraft fees with his tax refund that was needed else where. How are you supposed to get ahead.

Oh wait, one more! Last month, I had a bill paid through that online crap they offer. A bill collector calls me wanting payment. Um, I'm looking at my account, its cleared, and they say no, they don't have it. The Bill collector gets the check next day in mail but the bank cleared it before the collector received it.

This is what also happened with the case of paying my bills 2x in one week, asked me to hold the check because of a screw up and the check cleared anyways, she got onto me for not telling the bill collector to hold the check but I did tell them to, then 5 days later the Bill Collector Calls and says "Hey! can we run this check?". The vice president did not know how that worked? Funny huh, then she preaches to me not to use online BILL pay and there's a big ass sign by her desk supporting online bill pay. Go figure.

I inherited 250, 000 from a estate and put it into my B of A checking account. I requested a 50,000 withdraw after 8 months. I checked with the local branch manager as well as the SVP of Northern CA, Mr. **. I was told that, "That's no problem, come in Monday afternoon. Great so far. Upon coming into the bank and keep in mind, I made this request 2 full weeks ahead to give them time.

I asked the branch manager for my money and was told they don't have it. Bank policy is to limit a customers' exposure to robbery etc. by not giving out all cash at one time. Okay, but since they do not have my cash available, if I want my money, I, the customer would have to drive all over Northern CA to as many B of A branches as it took to get the cash.

My response was your policy was to limit exposure, so that means every time I go to a branch, I either have to walk in with all the cash from different branches or leave the bulk of cash in my trunk. So, 50,000 and say all I could get from each branch was 5,000 that would mean I'm exposed ten times. I could be robbed or had my car broken in or an accident or a car jacking.

No wonder the banks are asleep at the wheel and in trouble. I called the SVP Mr. ** and said that's not my job .I'm the customer and because of their idea for me to get my 50,000. I want all my money. The next thing I find that B of A refuses to hand back the money. Now, I did not think I would walk out that day, so I gave them a week to come up with the total amount. I was then told by the SVP Mr. ** that B of A would hand back the cash in three payments, I said no.

Your bank screwed up, no apology to me. It took 45 minutes of arguing before he allowed me to have my cash int two payments. I said, "You are not my parent or guardian, what makes you think you can dole my cash to me like it was my allowance. You are treating me like a child. He would be happy to give me a money order and I can try to find a bank to cash it or they will wire transfer to another bank. They did not want me to remove the cash from the banking system.

Then today, they applied 7 more overdraft charges! The charges make no sense to me as there were funds available in her account when the overdraft charges were applied.

Rude, confrontational response when I attempted to cash in savings bonds. I was told by the previous bank manager the steps to open and access an estate account. When we attempted to cash the savings bonds from my mom, we were humiliated at the teller's desk and told that we were not able to access our account. We stated that the last manager had told us the procedure and the manager said that "is wrong" and you will not be allowed access. We became upset and instead of diffusing the situation, the manager became very confrontational and inflamed the incident. The bank officer pulled up the account when my husband threatened to take out the money (interest free). She was flippant and said, "Oh, these are little accounts. Ok, we can close them."

They actually have a lot more of our money. Their attitude is always that the patrons are subservient to the bank. All the other BOA centers near us are very courteous and the managers there have excellent customer relation skills to handle us and resolve any problems for us. The attitude of the branch is very malignant in this economy. Poor customer relations—increase the training. No legal consequences at this time. I will be watching them.

I am writing this to complain about the terrible customer service I received a month ago from a Bank of America credit analyst by the name of Nikki **. I placed a call to Bank of America to inquire about a couple of things: (1) I wanted to know why I was charged a late fee on my credit card when I paid my bill in the bank the date the bill was due, and (2) I wanted to know why my business credit card limit had been reduced.

I was then told that I would be transferred to another department. Mrs. Nikki ** and her very nasty attitude became quite apparent when I asked why are all my business accounts being reduced. She started saying I wasn't using the balances that had been provided and that I was not over and beyond my limit. I tried to tell her that I was trying to establish some good small business credit. She stated I no longer need those limits because I was not using them. She started looking at my credit which meant she was pulling it (which I did not authorize for her to do). I then stated to her that I did a balance transfer to take advantage of 0% interest being offered for a year.

She then closed the account I paid off without my permission stating that Bank of America had extended my enough credit already. Keep in mind all I was calling about was a late fee that was not late. As the conversation began to progress, she began to act cold and heartless acting as if I had done something wrong by questioning her about my credit. When I expressed my concerns over her closing my account without my permission and how I wanted to protect my credit, she stated she didn't care and closed the account anyway. I have excellent credit that I need to protect and have never been late in paying my bills. I am well aware that when accounts are close regardless of who initiates it, it affects your credit.

I then tried to escalate my issue by asking to speak with a manager who did call a few days later; she was not much help either. All I asked is to have the account re-opened. I have no problem cutting up the card and am not using it. I just wanted the account to remain open in a good positive standing and she stated she could not do that. I then asked, “Why is that?” When you took upon yourselves to close an account in perfect good standing, because of what? Does Bank of America not care for the small business of small businesses such as mine or is it that they only cater to large Fortune 500 businesses? Based on my experience, I can tell you what I think the answer is.

For me, poor customer service coming from such as theirs or any corporation for the matter is unacceptable. I have been a long time customer paying off automobiles and the convenience of seeing Bank of America on every corner was great as well, but enough is enough. Yes, one person, Mrs. Nikki ** can really ruin a great banking relationship and experience with awful customer service received on that evening.

I need some help! Bank of America is breaking fair trade laws and probably banking regulations, preventing me from getting a government restructured loan that I applied for and that they themselves qualified me for. They lost my entire tax returns 7 times, lost IRS documents 5 times, they kept saying they have them but another FedEx would come requesting them again and threatening not to give us the making homes affordable loan. Now after 6 months they are again asking for our tax returns and we have 30 days or we will have to pay 10,000 in back mortgage and not be accepted into the program. We are over a barrel, we have the proof that they are trying to force us out and we need someone to read the condensed version below.

We have no other choice but to send this letter to everyone we can think of that may listen. I signed up for the making home affordable with BOA back in July of 2008. I was out of work and they sent me a letter saying that I qualify. I called, and I did after all qualify for the program which would drop my mortgage by 1000 per month. I sent in all the requested docs, and then was asked for them again. I faxed them and they didn't receive them. These are full tax returns, w-2's everything each time. Two weeks went by and a FedEx arrives with a letter saying we qualify and we are to make trial payments to BAC home mortgage in the amount of 1900. That's better than 3000.

We start making these payments and get phone calls on Sundays saying that they are missing information. I call and they say, well it's not us that is missing information, it's the Hope team and here's their number. The Hope team isn't open so I have to call back Monday. They tell me that they don't need any info and don't know why I was asked for it. The next month they call and say they're missing the tax returns. I fax them 2 times and mail them once just for good measure. Three weeks go by and they now are missing an IRS form. I tell them that they already have it and end up faxing it in 2 times. They didn't get it after 2 weeks more and I fax it again and mail it.

Three more weeks and they don't have my tax returns and if I don't send them in I don't qualify and now I am on the hook for all of the back mortgage that I would have otherwise paid. I tried to use my Home Depot card to buy some stuff and it was denied. I called and found out that BOA had reported to my credit that I was defaulting on my loan and was reporting it even though I was in their own program. Long story short, they told me that it's automatic in their system and I would have to call every month to get the last months report to the credit agency removed. I did that, and I must every month. But my credit is still being affected.

Now back to BOA. We have been making our payments on time and we get a FedEx saying that we're missing some important documentation for our modification. Tax returns and such. More phone calls to all of the departments because the phone numbers that are on the letters they send are not the ones to call. In fact they are to other departments other than the right one. I fax 2 sets of our entire tax returns in and mail them too in their FedEx pouch. I call 2 weeks later to check up. The lady on the phone says we have received all of our docs and it is going to underwriting. I get another call on a Sunday saying we're missing some stuff. I call Monday and they say we're not missing anything.

Three more weeks and I call to check and the lady says congratulations! Now just wait for the final docs to arrive, sign them and you're all done. What a relief! I jumped up and down with joy. Three more weeks and I get a FedEx saying we're missing tax returns in their entirety, and form whatever from the IRS. I call and argue and then send them again and tell the people on the phone that I was already told we were approved and waiting for the final docs. There is no record that anybody told you that they say! Stress! Faxed returns again! Three more weeks and I call to check.

Now we're in December 2008. They have all they need and it's all going to underwriting. Christmas comes and goes and we are missing more paperwork. This goes on like this until today when I got another FedEx saying that I need to send them my entire '08 tax return, the hardship affidavit, check stubs from work ( I am still unemployed), a signed notarized copy of something else, etc. I was on the phone 4 hours today trying to get somewhere. Finally they are helpful and figure out that they indeed have everything and they don't know why BOA is asking for more. Keep in mind that if I don't send in these docs they will deny us and we will be liable for all of the back modified payments in cash and the next months mortgage.

That is 3000 plus lets see, 1100 for every month since September, that's right about 10000. The supervisor got on the phone and tried to talk me in circles telling me that I needed to send in the documents or I won't get the new loan. They have them and they are not willing to give them to the underwriter again. It is up to me to send them in again. I asked why I need to send docs that they already have and he said because they asked for them. All of these documents over 6 months they have lost over and over again and now that I am under a 30-day time frame, what do I expect?

I expect to get a letter after the 30 days is up saying sorry we can't give you the new loan because we didn't receive the docs. I have all of the proof of all the other times I sent things in, and I could have proof that I sent the new ones in too, but if they say that they didn't get them, I don't get the loan, and have to pay 10,000. All of this even if I can prove everything every step of the way. I need help, and I don't know what to do. They are making it impossible for us to get this government program by continually putting up roadblocks that they are aware they are doing. I need help! I have all the notes of conversations and faxes to them over the last 6 months. So much stress, I can't stand it. Consequence is relationship troubles with my wife and child, etc.

Then on January 23, I made an additional purchase of $3.00 using the same debit card with pin. My debit card isn't supposed to be used as a credit card but it has (even though I have asked the bank several times to disarm) been known to go through, so on the safe side I always pot for the use of pin, my account balance would have been $1.83.

I wrote a check om January 24 for $76.57. I thought I had my other check book from another bank. I realized my error and knew that I would owe the bank for one $35.00 overdraft fee but instead got charged for three $35.00 overdraft fees. I can not understand how Bank Of America can justify deducting 3 fees from 3 different days by saying that they take the highest charge first as a courtesy. How is this a courtesy when the first two charges were from two previous days not to mention that my payroll check went in the same night January 24, that all these charges went in?

I am not a person to write bounce checks or in other words this is a rare thing. I have called and asked several people to explain how can charging fees for 3 transactions when to should have been covered if they were deducted in order as they were debited. I could even understand if they were on the same day but not three different days.

We have a car loan with Wachovia Dealership Services. My husband fell one month behind on his payment. He makes his monthly payments but he is still one month behind. They contact us again today, at least this was a reasonable hour, they call us up to 9:00 pm since they are opened that late. A woman name Lisa called to tell us a payment was not made, and I offered to give my bank information on the phone. She could not state I needed to go get a Moneygram. I told her that when my husband got home, he will call her.

My husband called her and she was so rude to him. She demanded to speak to me again, and told my husband that he was the problem in this mess and she did not want to speak to him. He asked to speak to a supervisor 5 times before she finally switches him to Eric M. He was worse than Lisa. He basically told my husband that he better find a way to make this payment today no matter what and continued to tell my husband that if he does not receive the payment, he is coming to take the vehicle away.

Now this place is a loan office. They are not the police or a place to confiscate cars. They speak too low and down to you that makes you feel you are worthless. I have never in my life seen my husband cry after getting off the phone with this person. After making numerous phone calls, I finally got a name of a manager who is Darren J, his number is 980-233-6850. Talk about putting people down, my God, I kept trying to bring up the subject how his employers speak to customers, and he told me he knows how they speak to customers.

This is the way they are to treat people when they need to call on a late payment. Now, I am just fuming that they think they have the right to downgrade people, and to call us at 9:00 pm. I had to run out and make a payment which I cannot afford to do right now, to keep these people off our backs. It is just one payment. We do not have to be degraded because of this. I figured if I spoke to a manager, he would apologize for the way they spoke but he on commended them on it. Something needs to be done with this department. The constant harassment every day and tonight is unbelievable.

An attorney Eric H. submitted to Wachovia a garnishment for our account in the amount of $563.29 but Wachovia decided to place a hold on both of our accounts. The garnishment was satisfied on 1/29/2010 after my husband's direct deposit hit his account. I contacted them to explain that since you have fulfilled the garnishment by taking the money out of my husband's account, I would like for you to please release the hold from my account because we only have the one garnishment to prevent a double payment which will take forever to get it back.

Not only are we not allowed to use our accounts, but they placed a hold on the entire account so we are not able to pay our kids tuition, mortgage, get food—nothing. And this is what they told us: "Sorry, we understand your frustration but there's nothing we can do to help you." How about removing the hold for all except the amount of the garnishment? Also, we contacted the lawyer "Eric H." again who stated they submitted the notice to the bank but the court date for settling the account is March 12, 2010. So why in January has Wachovia placed a hold on our account two months ahead of time?

We are getting no where after numerous calls and needless to say we have other items coming in that we will have to pay NSF charges that Wachovia love to charge even when things are not our fault. Can someone please help us? We need someone who cares about customers and not the mighty dollar. Maybe the lawyer should have held the request until it was closer to the court date and even his office was very nasty saying if you pay your bills, you would not be in this mess.

Well, we paid the bill and are still in this mess because we have two accounts still on hold and no way to get a dime of our money to get gas for work or food to eat or to pay anything else. No wonder people are so frustrated and outright ** off these days because everyone is always in their pockets and you can’t find help anywhere anymore. We have no money to get food or gas or pay our bills. They placed a hold on two accounts and even after it was settled they have refused to remove the hold.

Transactions change from cleared to pending in order to allow the bigger purchases to clear first causing my account to overdraft; not only that particular purchase but all the smaller purchases as well. This allows them to charge even more overdraft fees on purchases that were already cleared.

They have done this numerous times. The most recent incident; I had a total of five small purchases ($6-12) all of which had been cleared and $309.00 in my account. A check of $600.00 had been processed a couple of days after but was dated the same as the 5 small purchases and placed before them, causing a negative balance of $291.00 + 35.00 overdraft fee and five ($35.00) overdraft fees. Crooks!

I am in deep financial strain as I live paycheck to paycheck. I have yet to recover from the last incident from them and want to cancel my account but I am told that I have to bring my account to a positive and they charge an additional $35.00 fee every five days that I cannot pay the overdraft fees. I have been baking with BOA for almost 4 years. I did not have any major problems with them until this past year. My main complaint is their excessive overdraft charges. The last time they charged me 5 times, all in the same day, plus an excessive overdraft charge, to a total of $180! They refused to waive even the excessive charge. That was a lot of money and I could not pay bills. They did it in a sneaky way. One OD was probably correct, but they rearranged even the smallest checks or debits and slammed me. There have been a few more since then that were questionable. I was sure there was money in the account when I made the withdrawal.

Since this occurrence I haven't even been writing checks or using the debit, just paying bills online. Well, their recent charge was an electronic debit that made it go to minus $2, yep, and then there was their $8.95 fee. Yep, you guessed it, charged me twice! I hope that's not another charge! I was going to wait until the end of the month to close this as I opened a new account yesterday, they charge 0 checking fee, 25 overdraft, free check cashing, and 16 for custom checks, which is much more reasonable. So I will go there today and close it, and I will tell everybody to stay away from that back, they will steal your money. And they would not even wave one charge! After I've been a customer for 4 years. There will be one day I get an inheritance and believe me, BOA, will never see any of that money. I have trouble paying bills due to excessive charges and fees from BOA, totaling around 5, 6 hundred for the year for nothing!

I thought that this would remedy the situation, but it was just the beginning of over $700.00 worth of fees charged to my account--a real domino effect. I was not alerted or notified until after the fact.

The following day, I took off from work to go to my local branch to see if someone could help me. They were rude and nasty to me, claiming it was all my mistake for overpaying. I said that I would be closing my account and the manager said, "That's alright, but not until you have a zero balance." I left the bank very upset and the spiral has continued to a total of almost $800.00 worth of fees in a matter of seven days. He told me the account was $889,000 in the negative but the rep advised it would be available in 24 hours. The next day the funds were not available; the rep said 48 hours. The next Tuesday I checked the account and the rep advised me the account had $88.00 and nothing else was pending on the account.

There should have been at least $1000.00 left from my pay and my husband’s, so I know they were incorrect. I was connected to risk management and Gabriel advised me that I deposited a money order for $3.00 and put that it was a $300.00 value and took $100.00 of it out and that was why there was only $88.00. I told him that was impossible since the CDs from the account were CXL and I only received them the day before I got paid and I didn't deposit and buy money orders. He talked to me like I was a liar and told me to go to claims and then refused to give me his supervisor, stating there wasn't one.

The same rep also told me that this account was an individual account and not a joint account with me and my husband. That was why his check never posted. When he added me to the account they removed his name from the account over the phone. We bank online, so we very rarely go inside. Gabriel also told me that my account was opened in the local branch. It wasn't. I was also told that I couldn’t get my money until they closed the account on the 28th and mailed me a check. Bank of America is the worst financial institution. I never want to see them again. I was unable to pay bills buy groceries or even gas. I had to ride with a friend to work and eat ramen noodles for a week. I have 2 children that had to stay home with my husband since we couldn’t pay for day care that week. I was away due to my father’s death since November. Bank of America charged me $267 plus in overdraft charges for the same payee unbeknownst to me. They did not contact me, only thru regular mail. They did not try to contact me via phone, but continuously charged me $35 fees each time this particular payee tried to debit my account. This payee is a pay-day loan company that knows I am going thru a debt consolidation program, but continues to try to get their $$ thru ACH debits. I do not feel I am responsible for these debits.

When I called a representative before I left, I had a small debit in my account. I asked the representative to close my account. She stated that they could not due to debit. Then I asked if I could "block" this account from any further charges. She told them there would be a fee to do so, I believe it was $30 per payee. Which I thought was ridiculous. Bank of America is absolutely ridiculous with their fees. They take complete advantage of customers like me who are having a difficult time in this economy.

I believe that this is customer negligence on their part. I do not feel I should pay their fees ($267-plus) due to this. They have already received plenty of fees from me and I don’t want my credit, license or credibility ruined over this either. I send an email yesterday, 1/26, explaining that I want this account closed and the fee issue. They advised me to contact customer service. I’m not doing that again. They seem reluctant to reverse the fees, and said it would have to go thru an account manager to close! Please help! This can’t be the only complaint you have received regarding Bank of America. Thank you. It resulted to $267 in fees, in which I feel I should not be responsible for, and the account is still open! They will not close!

I live from paycheck to paycheck and cannot afford to pay a double fee for one transaction. I spoke with Customer Service and a Support Specialist and was told this was legal. They refused to remove one of the $35 fees from my account. I was offered a credit of $11, which I refused. I feel that they should credit the entire $35 but they say they are not able to do that.

On 1/22/10 my fiance and I went into Wachovia Bank branch with check from the Florida Lottery. At the lottery office, there are signs posted informing you of which Wachovia Bank branch to use to cash checks on the same day it is issued, without problems.

Once at the branch, the teller Mrs. Darlene ** rudely stated to me that she couldn't cash the check, and the only way I could get any cash was to open an account with Wachovia. She also stated if I opened an account, she would be willing to give me $2,000 cash back but the remaining balance would have to be on hold until Tuesday 1/26/10. I asked her how it was possible that she could give me some of the money today and why is there a hold on the money when the check is from their account holder (bank).

On 1/26/10, I went into another Wachovia branch in Fort Lauderdale, FL to withdraw funds. Once inside the branch, I was told my money was not available and I had to wait another day to access my funds. As a result of Ms. **'s lack of enthusiasm to help me resolve my issue, I felt discriminated against, less than lucky, and my day went from being the best day of my life to the worst. I believe Ms. ** chose not to help me because of her own personal reasons and not because she truly could not.

I was laid off, and had not deposited money for a few months into my BofA checking account. I called them and was told that they would waive all account fees for the next 3 months as well as reverse the fees generated from their account monthly fees. It’s nice of them, I thought, and apparently a program they implemented in response to the economic crisis. Not only did they fail to do any of what they said, they closed my account without my knowledge about two months later.

Not knowing this, I made a deposit for just under $300.00, which the ATM accepted without a problem. This was 6 full days after they had closed my account, so the ATM should not have taken the deposit, obviously. Then, when I called, they were unable to look up my account, much less track the checks I'd deposited. Fine. I went to my local branch on the next business day. I was told my deposit amount would be returned to me via U.S mail, a new debit card would be sent to me, and my account would be reopened. In good faith, I deposited another $84.00 to reopen the account that day. I made this deposit personally with the bank rep handling it for me. I got a receipt.

Not only was nothing sent to me in the mail within 7 days, it's been 10 days, and not a single thing has come. Also, I cannot access my account using their customer service automated line, as it says it does not 'recognize' either my account number or social security number. Apparently, the account is still closed. Yet, that did not stop the bank from putting a check through that I had already told them about, having written it before I knew they had closed my account wrongly. So, now they are charging me an additional $35.00 fee on an account that doesn't even exist to them. Interesting, no? When/if the branch manager returns my call, I am not going to let them do anything but return my money, which will be over 350 dollars now, and will close my account. I will never bank with them again since this is how they treat loyal customers of over a decade.

I have a house cleaning business and I make my deposits daily at the drive-thru ATM on Washington Blvd./Patapsco Ave. Many times when I try to make my deposit, the "cash deposit" or "check deposit" button is already compressed, which will not let me click on the button on the machine. If a deposit is made by 8:00 PM, it will post that day. Sometimes, I go there within minutes of being able to have the deposit post that day. I've complained to the bank many times about the malfunctioning ATM and they keep telling me they will have it fixed, well, it is not fixed. Now, my account is overdrawn and they keep charging me fees because if the account is still negative after a week or so, they charge you another fee and it keeps going up.

They also state that if you are only negative a minimal amount, you will not have fees assessed. I was only negative $7.11 and that's what it says on my online account, but they still charged me a fee, and then it was like a domino affect. I told them I could not make my deposit because the button for "cash deposit" was already compressed. I had just made a couple transactions that day and had until 8:00 PM to deposit money so my account would not be overdrawn. But, because the ATM would not let me do so, I had to wait until the next day and by then, I was overdrawn. I get paid every day by my clients and make my deposits every day as well. I've been with the bank for over 2 years.

They also raised my monthly maintenance fee from $5.95 to $8.95 and offered a free checking if opened online. I did so, but my PIN never worked. I complained several times and all they kept doing was send me a reminder of the same exact PIN, that would not work. I would have used the free account I opened if my PIN had worked, therefore, I had to used my original account and after they would take out my monthly maintenance fee, other items came through, and I'd be overdrawn even more. I think it's a scam and a way for this bank to get more money out of their customers, whom they claim they value so much.

It's ironic because this is the same bank that was awarded millions of dollars for a bailout, but, doesn't care to help their own customers with problems like mine. I've switched banks and I've told Bank of America that all I want is to have my fees returned, for an ongoing problem that's not my fault and I want a zero balance so I can close my account.

I am being charged overdraft fees based on the available balance of my account and not the actual balance. Bank of America places an authorization on funds when a debit card is used and even though the funds don't leave the account for 3-4 days the available balance causes overdraft charges when the actual balance is enough to cover the incoming transactions plus the authorization. Then when the authorized transaction clears the account, there are more overdraft charges because the bank has assessed the account the previous overdraft charges.

I have been fighting with Bank of America for over a year about the way that they assess these fees. It is unfair to the bank customer and if Bank of America did not have my mortgage, I would move my checking account to another more customer friendly bank. I have paid $420.00 in over draft charges since December1, 2009. I get charged at least two-three $35.00 fees every month and sometimes more. I am at three already this month and will probably get more. Their system is impossible to keep up with. If I see that my account is in the negative, I make deposits to counter act the negative and still get hit with overdraft charges. Bank of America is killing me financially. Please somebody help! I am struggling to meet my monthly expenses and put food on the table for my family because of the excessive overdraft fees that Bank of America charges and the way that they use the available balance and not the actual balance of the accounts.

I opened a checking and savings account 3 months ago, I had direct deposit, I kept the change savings and was suppose to have overdraft protection. On 1/15 my deposit went through and for some unknown or unexplained reason they had my funds on hold without letting me know. Due to that I incurred three $35 overdraft fees.

I called customer service to complain and find out why the money was not debited from my savings, the 3 fees overdrew me by $1.43. The representative refunded the $105 in fees and promised to set up the overdraft protection, although he failed to tell me the credit would take 4 days to post, so while waiting for my money to be returned by them I got his with 2 more fees of $35 each which meant for the 2nd time the overdraft protection was not set up.

I did an online chat with a representative named Morgan who was extremely rude and basically told me she would be more than happy to close my account rather than help me. I left the chat with no resolution and no action to be taken. I then did another chat and got a representative who did refund the $70. Two days later I checked my account online to see if the refund had posted and noticed my savings account was closed. I had to call once again to have it reopened and they had no explanation as to why it was closed. Thinking this was finally resolved on the 22nd at about 6am I checked my account online again just to be on the safe side and now the checking account was closed.

I once again chatted and found out the rude representative Morgan put in a order to close my accounts just to be mean I suppose. I had to have the account reopened and finally got a supervisor named Korey who assured me the account was reopened and my balance would be available within a hour. Seven hours later I check my account online and I see a $0 balance.

Again, I have to call and I got a representative, Amanda, who has no idea what happened to the money so, I asked for her supervisor. The supervisor tells me they decided to mail me a refund check on my account balance for whatever reason - no one seems to know. I was so fed up at that point that I did ask her just to close the accounts. I was even declined to go to a branch and withdraw the balance instead of having to wait 2-3 weeks for a check when I haven't even been able to use any of my money at that point in 7 days.

In addition, I had to keep the change savings account where I am matched my deposit 100% for the 1st 3 months. While waiting for my refunds I had to transfer all my savings to cover my checking so I would not incur more fees, so I lost $52.05. I did ask to be compensated for this and was told, No. I lost $52.05 out of matched funds from having to transfer money to my checking account to cover the overdraft fees I was charged while waiting for them to be refunded.

They had already debited my current checking account for the opening deposits though. I went into a branch the following day and withdrew that money and the teller asked if I wanted the accounts closed. I advised her that it was already being done.

Three months later, I receive a letter in the mail regarding my open account. I called the number on the letter and got transferred around. I was advised that the accounts were closed but still showing active and that I had a -$10.00 balance on the savings account for maintenance fees charged the last two months. When I asked when they would be removed, she advised that because they were maintenance fees, they wouldn't be removed. I asked to speak to a supervisor and was put on hold, then told they were busy and when I requested them to call me back, I was advised that they can't make outgoing calls.

Who has ever heard of a supervisor not being able to make outgoing calls. I have worked in call centers and have never heard of an experience like this. I have only a Debit Card. I decided not to have Overdraft Protection. I called Karina, the supervisor at the branch when I opened the account back in 1998 but she did not it explain well.

I asked her that I could not see any negative amounts. And I do not understand why transactions go through if there is no enough fund in it. Aren't Debit Cards supposed to work like a cash card? I do not ask the bank to cover the short. Transactions should be declined if there is no enough fund.

I believe that BOA trapped customers with this kind of system. They would cover the purchase of payment using debit card even though there is no enough fund in it. And at the same time, they will charge fee of $35. Easy money for them, but it is illegal.

We purchased a 2008 Dodge ram truck. Our contract started 9-4-2007. Right away, Wachovia dealer services accused us of not having our own insurance. I insured the vehicle on the same day we purchased. Wachovia issued their insurance to our account anyway in the amount of $1,648. I faxed them proof but that didn't do any good.

Next, when it was added on the truck the following month, my insurance was up from $215 to $1007 per month. We could not afford that kind of payment so we did not drive the vehicle and went shopping for a cheaper insurance and Wachovia charged me another CPI adjustment in the amount of $1,648 from 12-2007 to 2-5-2008 and said they charged us $360. After that, I have had my own insurance but that didn't stop Wachovia from adding their insurance

We let them know we had our own where the CPI adjustment were we noticed payment was missing on the payment history sheet they sent to us. We got a letter dated August 24, 2009 stating that they had put three payment of our in a general ledger account because they didn't know who the payments belonged to because there was no account number. They could have found out who they belong by our names and address. They said they applied the payments in November 2007. They applied my January payment in February and my February 19th payment was applied for February. Our payments were due on the 19th of each month.

I asked Mrs. Elaine *** who worked in the Office of the President of Wachovia in Texas why did she apply my January payment to February when i made it in January. She started talking to me in such an unprofessional manner. I made an April 2008 payment and Mrs. E. stated that I did not make that payment. I had faxed this payment to the March lane Stockton office after they decided to repo the vehicle without even giving us a warning, no certified letter or anything. She first told us that the missing payments that was in the ledger account made us delinquent. Then she said we were 107 day past due for our March 3, 2009 which caused us to default and the vehicle was repossessed.

The vehicle was sold and now they are telling us since June 18, 2009 they are not going to do anything or give us restitution at all. I explained to her if we were 107 days past due for the March 3, 2009 installment, she would have to go back to December 2008 to March 3, 2009 to come to the conclusion that we were in default. I have been trying to talk to Wachovia reps since they took the vehicle and we had no luck. After the vehicle was sold, they called concerned about the deficiency balance when they would not talk to us about how we could get back our vehicle. They said they wouldn't give the vehicle back because we were concealing it.

The vehicle sat in our front yard the whole time we had it. They used concealment to keep from giving the vehicle back. What can we do? I can show the copies of that March 2008 payment that Elaine *** said that caused this entire mess. They have given us one excuse after another about why they took the vehicle. We have receipts from December 2008 to March 3, 2008. Elaine *** told us if we sent her the April 2008 receipt, she would fix the problem. Now she tells me she is not going to do anything about this problem.

We have lost the money we paid into the vehicle and lost the vehicle. Wachovia is guilty of concealing our payment and a few other things. They did not recognize any of the payment that they had in that general ledger account. Wachovia reported the vehicle stolen. Wachovia could not legally report the vehicle stolen from their bank because we were the registered owners. We want to report Wachovia to the FTC for being in violation of FDCPA, the Fair Debt Collection Practice Act. We are demanding they pay us the money we gave them in the amount of $551.18 x 20 months equals to $11,023.60.

When we asked for the exact dated in writing, Mrs. Elaine *** refused to do so. She started yelling at me on the phone. I had to tell her I would talk to her at a later date because she got upset for no apparent reason except she feel guilty and don't want to admit that they made a mistake and are refusing to correct it. What can we do? Should we get a lawyer or can you help us? I wrote to the comptroller of currency and they put the mess right back on Wachovia and Wachovia put it back on us. I can provide proof of that April 2008 payment to you and send receipt from 12-2008 to 3-2009 that made us past due. From our understanding, Wachovia has been bought out by Wells Fargo. We called Wells Fargo and they told us they did buy out Wachovia but the loans on the vehicle and homes were still with this company.

I contend that paying over 600% annual interest to cover $100 to $200 for two to three weeks is just greed by Bank of America. Credit cards don't even charge that much. Credit cards charge up to 30% interest, but no more. Bank of America lends me the money for two weeks and charges over 600% annual interest and sometimes more.

For example I have had charges of $40 that were charged $35 in overdraft fees. That is 87% monthly and 1044% annual interest. I would be willing to allow them to keep $5.00 of each fee which is reasonable for processing. Please advise if you can help. This letter is regarding a customer service issue on behalf of employees Bertha, Acct. Manager/Supervisor and her assistant Rita. (last names were withheld by Wachovia Bank).

On January 8, 2010, I made a car payment in the amount of $581.00. In order for me to be caught up on the car payment, I owe two more payments. I requested to make the two payments at the end of this month after I file and receive my income tax return. I have been on a medical disability designated by my primary physician since September 2, 2009 to the present because I was threatening a miscarriage in my pregnancy. I have not worked since September 2, 2009, but I managed to pay all my car payments for the past 5 years. I am only two months behind, but I will be able to pay the two payments at the end of this month.

I requested a Hardship/Medical Consideration in this matter from Bertha and Rita at Wachovia. I was abruptly denied the request in addition to be humiliated verbally on the phone on January 14, 2010. Their unbearing and relentless attitude of how they talked to me in a derogatory manner made me not only cry but the situation prompted an anxiety attack, oncome of migraine headaches and severe abdominal cramping. I was taken to a nearby hospital where my physician stressed that I was going to have a miscarriage. I was stressed!

Bertha and Rita could have handled my situation far better than the way they did. It was the manner in which they talked to me. In addition, with the economic times as they are, I feel financial arrangements can be made on my behalf. After all, I have been paying on a Ford Focus for the past 5 years and I just made a $581.00 car payment just 1-1/2 weeks ago with the guarantee that I will be making 2 car payments at the end of this month. Therefore, I will be caught up! Bertha and Rita vehemently said that the car will be repossessed!

I can provide medical and disability documentation from my primary physician upon request, if needed. In addition, my mother has spoken to Bertha and Rita regarding my physical and financial situation. To no avail, my mother was treated in the same manner – disrespectfully. I pray some disciplinary action can be taken regarding these two employees. If not, all I am requesting is that I am granted some consideration in an effort to pay my two car payments at the end of this month after I have received my income tax return. That is my utmost request.

Thank you for your consideration in this matter. I sincerely hope that no one will have to suffer the mental and physical anguish that I have suffered at the hands of evil-spirited, cold malicious, uncaring, so-called specimens of a human being. I pray that these two individuals will walk in my shoes or possibly one of their loved ones!

I deposited a check into one of their ATM. It was my first time at this particular ATM. The ATM noted it was returning the check, which happens at times, but instead of spitting the entire check out, it spit out a corner. Meaning, I would have to tear the check, $5,500 check. Mind you, not a small amount. Their ATM then ate the check and spit out my card, no receipt, no check. I was a bit flabbergasted and confused. I went into the branch and asked them to retrieve it. The woman went into the back office and came out to inform me they are not able access the drive through ATM. She then informed me I would have to open a claim, what? Am I hearing you right for a simple deposit? Well, we did that at the branch and the young lady who opened the claim informed me a credit would be issued that evening enough to cover $5,500.

I was a little surprised it was that easy and I had every right to be under that impression. I noticed my balance had not gained that amount the next morning and that there was no deposited or credit to that amount made. I called to check on the status, thinking maybe it would need another day to clear onto my transaction list. I was told by everyone I could get a hold of that not only would they never ever offer a credit but they would never do it unless they had proof I made the deposit and that if they decided to give the credit, it would be ten days after the onset of the claim. They also told me there would be no guarantee the deposit would ever be made, ever. That it may very well be the check would just disappear.

I was advised to just have a new check sent as they would not be able to do anything at all. Even if they were to find the check, they would not offer compensation if they did not want to based on the condition of the check. So let me get this straight. Your ATM takes my check against my will, not registering the deposit and your exceptionally slow ATM guys can take their sweet time (10 days) to recover it. Then you still may not accept it. What crooks and oh, how much I love the insinuation that I'm trying to rip you off. Zero responsibility!

And the lender won't adjust my interest rate and refused to modify my loan. It's because even though my payments are much higher now than when I bought, they say since I am current, I do not qualify for a loan modification, even though in October, they advised me of a new program for owners that are current but upside on their home. Yes, denied, because I am current. Why have they told me to call back since March 2009; In October, I was told of new program. I provided all documentation. And then I got a call saying I am denied in January 2010.

I just started banking with BofA months ago.I was warned about that predatory fees and practices but my mom swore by them or she did until this incidence. I recently had an overdrawn balance and incurred an overdraft of $35. This is normal procedure so no problem. It was my mistake so I have to pay the fee. I have my paycheck direct deposited into my account making my account current, just to check my balance the next day to see that I was overdrawn again. I checked online to see a One-Time Extended Overdraft fee of $35 that posted the day after my check was deposited causing me to be overdrawn again. I called about the one time fee and was told that I could not get a courtesy credit.

So I was overdrawn again so that another overdrawn fee and to top it off. The transactions that was pending and already deducted from my balance was added back to my account and debited again (which the rep I spoke with says that is standard procedure with authorized pending charges) causing another overdrawn fee. So I was charged overdrawn fees twice for the same transaction, pitiful. I immediately closed my account and will never have anything good to say about Bank of Scams or Fees known as Bank of America

I have a personal checking account with Wachovia Bank. Due to job loss and financial hardships this past year, I have had several checks returned--all of which were paid and made good on. I was subsequently charged a $35.00 NSF fee for each of these checks. On 1/12/2010, I made a cash deposit for $250.00 to cover a utility payment I made over the phone using my Wachovia checking account. The deposit slip I received from the Wachovia bank teller said that the funds would be available the following business day. I didn't think twice about this because cash deposits are always available right away--or so, I thought.

While checking my Wachovia Online Bank Activity this morning (1/14/2010), I was shocked to see that the utility payment had bounced. I was charged a $35.00 overdraft fee, and they were holding my cash deposit for seven days. I thought for sure this was done in error so I called 1-800-WACHOVIA and spoke with a customer service representative and a supervisor who both claimed that they did not know what this seven-day hold was due to and that the hold was placed on my bank account by my local Wachovia branch in Old Saybrook, CT.

I immediately went to my branch, deposit receipts in hand, asking for an explanation as to why Wachovia is holding my cash for seven days, causing my account to be overdrawn and charging me $35.00 fees for it. The 'personal banker,' Mr. ** had no idea what this hold was about and after researching this matter for 15 minutes or so with no answers, finally had to call Wachovia headquarters to get to the bottom of this situation. The representative he was speaking with on the telephone obviously wasn't familiar with "cash deposit holds" because they were trying to figure it out together for a good ten minutes.

Finally, Mr. ** hung up the telephone and explained to me that since I have a history of overdrafts in my checking account, that Wachovia Bank will now be 'holding' all of my cash deposits for seven days before releasing it into my account. I am outraged. I can certainly understand a check or money order's funds being placed on a seven-day hold until a check clears, but cash deposits? So now, to compound my already dismal financial situation, I am out $35.00 for my utility bill. I will then be charged a fee from the utility company, and I also won't be able to access my cash for seven days.

In my opinion, this is just another ploy for Wachovia Bank to slap $35.00 fees on consumers like myself who are already struggling financially. Is it legal for Wachovia Bank to place "cash deposits" on seven-day holds simply because a person has had overdraft issues in the past? I am sure that in this economic climate, that I am not the only person who has had a check returned from Wachovia Bank. I would greatly appreciate any advice or further knowledge of this situation. I was charged a $35.00 overdraft fee with others to follow I am sure. I will be charged a returned check fee by my utility company, and I will not have access to the cash I deposited for seven days. This is discrimination!

Wachovia is using deceptive unfair practices to consumers, such as myself and others to fraudulently abuse their powers in charging frivolous NSF/overdraft fees of $35 each. Last week, I sent a mortgage payment check to Wachovia for $1076.00. Apparently, I was advised the held the check was received on a Saturday and the funds were withdrawn on Monday at midnight. Apparently, I was a few dollars short in the mortgage check and even with my overdraft protection being around $75.00, this still was not enough money to clear the mortgage payment. Wachovia should have declined the check and send it back to us.

Instead, Wachovia went on to take all my money, then hit me for 18 fees x $35 each for $630.00 in total. This makes no sense at all as the transactions were done on Friday, Saturday and Monday. The minor purchases should have all cleared with no problem at all. On another issue, I even withdrew $60.00 from an ATM machine, to find out I later got hit with a $35.00 NSF fee. This is ridiculous. Why can I be allowed to withdraw money from an ATM and make small debit card purchases with no issues at all when my money was available and the mortgage check did not clear? This is clearly a moneymaking scheme from Wachovia to hold checks on purpose, then hit you with fees on your other transactions.

I have lost $630.00 this week alone. It is unknown at this time what other fees I have been hit with in the past as I have been with Wachovia for over 4 years. I have lost all trust in Wachovia and the banking industry in general. Wachovia is clearly holding checks for days with the highest amount being processed first, then depleting my account when smaller and earlier transactions could have been processed without a fee. Wachovia routinely enforces a policy whereby charges incurred are posted to accounts in non-chronological order in an order designed to maximize their overdraft fees. Wachovia has abused my rights, which amounts to "bad faith".

I've always heard that banks will process your charges before they process your deposits as an extra way to rip you off. This week, Bank of America got away with $82 of my money because of this evil plan. I’d had $54 in my account for about two weeks. So on Sunday, I spent a total of $14 at Walmart and the mall when I got back to college, leaving me with $40. Monday morning I spent $31, leaving me with $9. At 1:40 pm, I deposited $105 into my account, and an hour later, I spent $21 at the mall. By Monday afternoon, I had negative $12 in my bank account. By Tuesday, I owed $82 because of two overdraft fees. Today (Wednesday), I have a balance of $22 because they finally processed my deposit.

They strategically waited until all of my charges went through before adding my money. I thought out all of the possible scenarios that might have put me to blame so I could have a logical comeback for everything they threw at me, and then made the call to my local branch. In less than 11 minutes, the woman I spoke to had implied that I was uneducated, a liar, and someone who obviously had no math skills because I apparently could not stop myself from overdrafting. She also made me cry.

I was still persistent, though, and I knew that she could see that I had my facts right. My intelligence is the one of the few things I feel fairly confident about, and the fact that she was reduced to taking cheap shots at me to try to discourage me really made me upset. When I asked to speak to someone who could give me the education she thought I needed, she tried to pawn me off on Customer Service. I then told her to transfer me herself because I wasn't going to trust any number she gave me, and she refused that, too.

In the last three minutes of the call, all she did was tell me that the only way I could prove that they were wrong was to bring in the deposit slip, but I had thrown that away when I got to the mall because I had already memorized the balance. I eventually called Customer Service, and the man I spoke to was the complete opposite of the woman. He told me that once the deposit was completely processed, the time should show that I was correct and that I can call C.S. back instead of the bank, and get it refunded.

I'm still waiting on the deposit information to go through, and I wouldn't be surprised if the time on it was incorrect, too. I'm going into the bank next week to cash the excess money I get from school each semester, and there's no way they're going to get any chance to touch it. I plan on making them give me $1925 in the smallest bills possible just to get a small amount of revenge (immature, but oh, well), speak to the manager about the employee, and then cancel my account.

Economically, I'm out $82 of the $100 I got from my dad for Christmas. Physically, I've probably gained 600 wrinkles from frowning. I could have dehydrated from all the crying I did, too.

After trying everything else, I decided that I should transfer money from my BoA CC to my checking account and consolidate two credit cards, both of which I am over limit. So instead of helping me, Josh ** (of BoA) said that they cannot transfer funds from my CC. Oh and by the way, he closed/cancelled my CC so I have no credit there now. Anyway, I'm frightened. Add to the stress, my husband has no idea. He's a wonderful, hardworking man but he has never had children so he doesn't quite understand the panic a parent feels. I am not lazy either, I just got over two weeks with pneumonia caused from working 90+ hours weeks. I am scared to death. I actually need about $500 to get on an even keel. I am not looking for a way out of my obligations, just a little help for right now.

Every single time you try to call Wachovia to resolve a problem, which believe me there are many, you are forced to answer 25 to 50 personal questions about your entire life and you have to understand all forms of broken English. It is no wonder people’s IDs are being stolen. Anyone who completes the interrogation deserves to have their ID stolen. And heaven forbid they ever have to transfer you to another teller. You have to go through the entire procedure all over again. Every single time they transfer you. I would have been paid off by now. I was planning to have my entire balance paid in short order. After my third payment, I never got a receipt.

I had an e-mail teller who sent me e-mail receipts to start. However, she lost her job as she knew what she was doing. You know there was another foreigner they could put in her spot, and it would only cost them a dollar an hour. Anyway, they refused to send me a receipt for months. After repeated requests for acknowledgment of payment, I finally decided that if I stopped paying they would ask why, and then I would get a receipt. Yes, I did get one finally. However, they informed the credit bureau that I was a bad credit risk as I refused to pay the balance on the loan. I contend that when they made that bad credit report, they committed libel. And for that reason I am charging them $250.00 for that crime.

To this day every time I contact them to resolve the issue, I end up hanging up as I refuse to give my entire life's history to a bunch of foreigners who can't speak a lick of English. When they respond and agree to my terms, I will pay down the loan in short order. I am forced to do this as it is so easy for them to make my credit look bad and so hard for me to correct the problem. Today's world forces us to air our private laundry in public. It is best that we fix all these problems with government soon. Government is getting less and less friendly all the time.

My next complaint has to do with there automated service charges that can occur after you close the account. The Banking Center refused to refund the $35 charge for a bill payment that was supposed to be disabled by the bank.

A friend of mine has had similar problems with banking centers and wrote the Bank of America executive board. His service charges $135 were refunded the next day along with an apology from some executive. I do have the email addresses for the board of executives if anyone else is experiencing these types of problems.

For such a large bank, these errors are completely irresponsible and reflect badly on the company. I was never refunded the service charges after I closed the account nor the $9.95 monthly service charge which they billed me for well over a year, despite numerous attempts and promises that it would be taken care of by banking associates at the Woodcroft banking center.

Not even on Saturday the 2nd, when the bank had business hours. On Sunday, I went home from my last unsuccessful deposit attempt, and get my own envelope, because I have set up my Wachovia auto loan to be drafted from my Wachovia checking account. I made deposit through the ATM, using my own envelope. On Monday the 4th, the deposit posts as deposited on Monday, not Sunday, and a $22 NSF fee. Nothing else.

On Tuesday the 5th, Wachovia Dealer Services loan payment posts to the checking account, which is processed successfully, but because of the NSF fee of $22, the loan payment overdrafts the account. If they hadn't charged the NSF fee, there was $8.03 more than required to cover the loan payment available.

on Tuesday the 5th. They charged me a $35 overdraft fee, even though it was their $22 fee that caused the math that resulted in the overdraft. I called and discussed it, and they said that the NSF was because the loan payment first came in over the non-business days, although it was posted on the 5th. I think that so then, since my deposit also came in also on a non-business day, and was posted, as well on the first available business day, even before the loan payment posted, that I ought to get the same privilege the bank took.

They "looked into" crediting the fees back for me and the "system" refuses. I argued why since, I have never asked for a credit before, never over drafted the account, never had a penalty before, nothing that should disqualify me from a courtesy afforded most Banking Customers regardless even of fault. The rep says she doesn't know but just that the system returned a 'no'. I think it has to do with the fiscal year, but nevertheless, I am closing my account with Wachovia, and urging my husband to refinance his auto loan through another lender! This was predatory.

i incurred $57 in fees for the bank being ill prepared for banking customer transactions, and for allowing themselves the financial benefit of transactions that "come in" on non-business days, but not allowing the customer the same privilege, for my transactions completed on non-business days.

On 12/31/09, BOA took $500.00 out of my account to cover the check that bounced. I contacted them on 01/03/10 and was told to call back the next day if I wanted information on my account. On 01/04/10, I contacted BOA again and was told that the $500.00 was removed because I had cashed a bad check.

I tried to explain that I didn't cash anything and the rep got defensive. She then transferred me to the claims department. The person in that department was even less helpful and more rude. She informed me that she couldn't help me and immediately transferred me back to customer service where I was greeted with an automated system. I then took off time from work to go to a branch for assistance. The representative there really didn't believe me either.

I got upset and requested information such as the name on the check, name of the person who wrote it, date it was cashed and branch it was cashed at. After she obtained that information, it was obvious that the teller made an error. After that, I was told an investigation would occur and I would get my money back in maybe 48 hours. After I left that branch, BOA then charged me four $35 dollar fees for overdrafts.

On 01/05/10, I called back to BOA to find out when I would get my $500.00 back and to request the fees be removed. The rep removed the fees but told me I would get 4 more the next day and that I would have to call back and get those removed. She said they were pending and she couldn't cancel them. I was also told that the bounced check was mailed to me and that they expected I return it to a branch as soon as I got it.

Bank of America has very slimy practices for account holders. There have been many instances when we have found ourselves overcharged for being overdraft. They have common practice of delaying your payment of large payments first and allowing the little payments to accumulate so that when they do put in the larger payment, it pushes you into overdraft.

This happens on a regular basis. Several times, we have requested payments to be made. They should post within two days. Then, the payee will call and say that the bank has issued it and subsequently take the payment back. Now, since this take back processed has taken a week or more, we go on with our account activity as if they have been paid. Again, we have been seduced into overdraft.

They really need to revamp their overdraft charging system. We have attempted to recover these unnecessary charges. Once, we were charged seven overdraft fees for one overdraft as they repeatedly put through payments that they know are already being made on the account with insufficient funds. We did once protest and ended up with a $12 balance.

Weekly, my husband has to call about their ridiculous overdraft procedure. The government is soon to pass, hopefully a bill limited the bank's ability to repeatedly overcharge the account using this stupid overdraft policy. i advise all to write to their representatives in support of this action.

This became an inconvenience for me because I kept track of my bank account and I would make purchases, payments, etc., according to my direct deposits. I was being assessed NSF fees continuously due to the unauthorized debits.

After several fraud filings, my account was credited only partial amounts for the NSF fees. The debits continued so I went to my local branch to seek assistance since the phone customer service representatives were of no help. I was advised by the local branch manager that the best thing for me to do was to close out that account and reopen a new one, so I did.

Shortly thereafter, I deposited a $2,000 check which was issued to me and was told by the bank branch that the funds for that check would not be available for two days. Two days later, I attempted to check my account online and was unable to log on. My password was "invalid" so I called the automated system and I was horrified by what I heard. My account was overdrawn $888,000! I quickly began making phone calls to the bank wanting to know what was going on. I was transferred to many different departments.

Finally, I was given a phone number to call the "risk department" so I did. The customer service representative advised me that my account had been closed because I had deposited a check from a non existing account and that it was considered fraud! Again, I was horrified, I quickly took time off from my job and went to the business who had given me the check. It was a very reputable car dealership who had given me a refund for a down payment I had made towards the purchase of a new vehicle. Since I changed my mind about purchasing the vehicle due to the terms, they reimbursed my money with a check from the company.

I went into the dealership extremely upset and advised them what my bank had told me regarding their check. They went to work on it quickly and contacted their bank who confirmed that the check had in fact cleared already with no problems. I felt like a fool! I then contacted Bank of America once again and this time, I spoke to a different person who advised me that the check I deposited was in fact good and had no earthly idea why anyone would tell me otherwise and then said that I was making the whole thing up! He then told me that my account had been closed because it had been overdrafted a numerous amount of times. I told him that the account was brand new and the reason I opened the new account was at the suggestion of the local branch manager.

I was advised that I should have never closed my previous bank account and that there was no record of me ever filing reports for unauthorized debits and there was no access to my previous account! I was mortified, I then asked about the money that was in my account when they closed it which totaled approximately $4,000 due to a recent payroll deposit in addition to the check I had deposited two days before. I was advised that I did not have access to my money and wouldn't for 10-14 days which was the time it took them to completely close out my account! I was furious! I had not a single dime in my pocket, my payroll check and an additional $2,000 was being held by the bank for no reason for two weeks.

I made persistent phone calls to get answers and all the representatives were rude, some were even sarcastic and would mock me by chuckling at the fact that I had no money and no access to my money. I finally got one representative to advise me that he had located the numerous unauthorized debits that I had filed and that he would take care of the situation for me. All I had to do was give him no more than two days to rectify the problem and reinstate my account. I waited the two days and still, my account was closed. My bills were due and I still had no access to my money. And to make things worse, I could no longer get in touch with the customer service representative who said that he would fix and reinstate my account.

I spoke to several representatives who told me that no such thing could be done and that my account was in the process of being closed so it would take an additional 10-14 days since I requested an investigation. I was desperate since I had no way of paying my bills. And now, I had to wait an additional 10-14 days. Once again, all my reports of unauthorized debits were nowhere to be located and all my information had somehow disappeared.

One month later, I received a check from Bank of America for less the amount that I had in my account. I once again contacted Bank of America and they advised me that they had a fee for closing out the account and since I had requested an investigation for the unauthorized debits, there was an additional fee assessed! In total, they kept over $200 of my money. I was fed up with the bank so I went to a local branch to cash the check I was sent by them. They refused to cash the check because, lo and behold, I didn't have an account with them and in addition, they told me that they had no way of knowing if the check I was presenting to them was authentic!

I showed them the letter, the envelope and the stub the check was attached to and the branch manager told me that they could not cash it because I did not have an account and that the check might be fraudulent. I told them that if the check was no good, then they would have to take it up with their "risk department" because that's where it came from. The manager and the employees were extremely rude! I finally made a scene by threatening them with a lawsuit, the branch manager then told me that he would cash the check but if it was no good, he would personally go looking for me! Bank of America Corporation are the biggest thieves I have ever encountered!

Every cent I had was held hostage for a month. I was assessed late fees for my home, my electricity was disconnected which assessed me an additional $100 to reconnect, my cell phones were suspended, I had to pawn some of my jewelry just to get gas and make it through the 10-14 days they claimed it would take to completely close out my account, which ended up taking 30 days. I had no money to buy every day essentials since I get paid on a monthly basis. Bank of America placed me and my family in a very bad situation for one month!

I recently opened a checking account with Wachovia, and it's been a nightmare. Since when does a bank put people on six month probation period? When in fact, the individual banker should be putting Wachovia on a six-month probation period. No instate check should every be held for seven days for verification of deposit. My agreement with Kolsum at the Leesburg branch was as long as I deposited into the ATM, drive thru or inside will not be held. Sometimes I deposit checks and I have no clue when I can use the account. Most of the times, the checks have been put through and other times they are held for up to seven days. No consistency at all.

I tried to close the account twice but am unable to do anything until the restraint is taken off. The first time for this and the reason is because I want to close the account out. Now I have to pay all the fees accumulating now. We all realize that Wachoiva made bad loans and took a bailout from the government and must pay it back. This doesn't give you the right to screw the individually account holder. I didn't make your bad loans and I don't want to be screwed over by fees. Because of all this, I must start an anti-Wachovia blog on the internet. Just as soon as the restraint is lifted, I am closing this account forever. Shame on Wachovia Bank. I was going to transfer my business account over to Wachovia but there's no way in hell will I trust Wachoiva with so much money.

We have been banking with BofA for about 15 years. We have all of our accounts through Bank of America, including checking, savings, mortgage, and a home equity loan. We are in the process of adopting a child from Kazakhstan, and one of the many requirements is that we need a letter on letterhead simply stating that we hold accounts with BofA and our accounts are in good standing.

I went into our branch the other day, and they told me they could not do that? They said they cannot issue anything on letterhead. I came home and called the corporate offices, and they told me the same thing. They said, "Sorry, we cannot do that for you!" I am mortified to say the least. For one, we need this in order to adopt our child. And two, they lent us the money for the adoption and they have "adoption loans"! Is this for real? I feel like I am in the twilight zone and this is just a bad dream. I'm so disgusted! I called another bank, and they said if I open an account, they could give me the letter I needed that day!

Bank of America has absolutely no interest in offering any real customer service to its employees. Instead, it tries to beat them in as many ways as possible with new fees and inconspicuous charges. Bank of America erroneously charged fees to my account that I could not get waived. When I called to confront them about these fees, there was a care free oh-well attitude with no interest in helping. I've had a student account with Bank of America for almost a year and a half now. I noticed that there was an online merchant tapping my accounts for a great deal of money. When I contacted the bank about the incidents, they just kept giving me the runaround. When I told them to close the accounts, they kept telling me that they could not do that because the accounts were in the red and that I would have to pay for the transactions that I was not responsible for before the accounts could be closed. Through much heartache, I finally managed to get the rep to "close" the accounts; but I was told that the accounts might not get closed. Is this the way BOA should handle its "valued customers" by attempting to force them to pay for transactions that they were not responsible for? To all who read this, I highly suggest that you not use Bank of America; or if you already are, switch your bank.

I forgot to write down a transaction in my checkbook that was due to come out of my account on Monday, Dec 21st. Over the weekend, I had done some Christmas shopping so there were several transactions pending to be posted to my account that Monday the 21st. Well, Wachovia does not post transactions in the order in which they are received. They post from the highest amount to the lowest amount. So instead of getting one $35 fee, I got 7 of them which totaled $245. Them taking out their fees caused my account to become overdrawn. With the holiday, the bank's ridiculous hours and a 2PM end of day cutoff time, I was not able to make a deposit into my account until Monday, Dec 28th. So I then incurred two more $35 fees. So now I have paid out $315 in bank fees. I contacted the 800 customer service and got $44 back from them. I asked to be transferred to a manager to see if the manager could help me out more.

After explaining my situation, he basically said, "Well, don't overdraw your account and you won't have this problem" then hung up on me! So after the holiday, I contacted the branch manager of my local branch where I opened my account with. She was able to give me $70 more back, but also tried selling me on opening another account or getting a credit card with them for overdraft protection. They are ripping their customers off and looking for the most profitable way to do so. I don't think this can possibly be legal. They made $201 off of my mistake. Now I could have handled the one $35 fee, but 9 of them. There has to be something we, as consumers, can do. This isn't the first time they have gotten me with ridiculous fees, but it is the last because I switched banks. I want my money back.

Wachovia Bank has swindled me out of $280 by placing transactions blatantly out of order. From Thur., 12/24, through Mon., 12/28, their online banking website showed that I had a posted balance of $261.73, with holds of $144.14 with dates showing back for several days. The holds were covered, but were still not being processed on Mon. 12/28 nor was my deposit from the previous week showing up either. I thought it was strange that no transactions were being processed yet, after such a long holiday break.

On 12/29, an expected larger auto debit of $305 suddenly appeared ahead of everything else. But this auto debit had been moved and processed ahead of the holds, even though it had a later date, resulting in all of the hold charges suddenly processing afterwards, and all at once, subsequently resulting in $280 overdraft fees. At the same time (all of this taking place literally overnight), the automatic deposit from the previous week was now being processed last, which was conveniently giving the bank the opportunity to take $280 in overdraft fees out of it. Their only argument was, "The larger debit had to be paid first, even though it was submitted last, and the holds could not be processed until they received the receipts from the vendors".

I guess they somehow just managed to receive all of those spread out hold receipts all at once. The bank also claimed that the deposit was not made until the same day it showed up on 12/29, but have themselves previously stated to me, that it takes several days for auto deposits to process and show up, which now contradicts what they have previously stated.

I am not sure of how to tell this story. I am a retired 69-year-old man and I live on the border of Panama and Costa Rica and my retirement is automatically deposited in to Bank of America. On July 31, my debit card expired. In June I called Bank of America to inform them that in 2005 I had a problem getting a new debit card. I was informed by the person I was talking to that there was nothing they could do and it would be automatically sent to me on July 15th. To make a very long story short, it is now December 23rd and 42 calls to Bank of America later, 8 debit cards later, and the only thing I have ever received from the bank are four PIN numbers, but no cards to go with them.

In five months, Bank of America has managed to destroy my retirement as I once knew it. I have had to sell off many things just to stay alive. I would like to say one more thing. There are two FedEx offices in David, Panama and I have pleaded with some of the people I have talked to and asked to have my card sent by FedEx and I would pay for it. It’s the same reply: this is not the place of Bank of America, yet the first 4 cards sent to me were sent by FedEx knowing that the contract Bank of America has with FedEx does cover delivery outside the United States. My wife and I went to the bank in November 2009 to close our checking account. We both talked with the bank manager and told him we wanted to close the account. He had us turn over our debit cards, gave us the balance, and said we'd get a notice in the mail confirming that we'd closed the account. We received a bank statement one month ago showing one cent in the checking account. Today, we have a notice saying we owe the $8.98 for service charges on the account. What do we have to do to get rid of these guys?

If they were going to assess a service charge for closing, why wasn't this done the day we went in person to close the account. I don't think we owe them a thing. I'm concerned that if we don't pay, they'll start to charge us overdraft fees. I don't want to just try and work with these guys alone. The reason we changed banks in the first place was due to really lousy customer service. My wife and I currently have $4,300.00 worth of debt. We paid our mortgage off with BOA in May 2009, so we're not some of these folks who are disgruntled about paying interest on debt we owe. We just want to end business dealings with these clowns.

Should we get an attorney, because if they're saying we owe $8.98 as of 12-15-2009, I'm sure we're incurring overdraft charges according to "bankster" logic. Please advise. Oh, and my complaint is just that we closed this account and shouldn't have to pay a dime since we weren't told of the charges at the closing.

On December 25, 2009, I checked my account online to see how much I had left in my account in order to buy a few groceries. I knew it wasn't much because I had checked my account for the past two days before making purchases for Christmas. This was mainly to make sure my deposits had been made to "pad" the account for stuff I still need to buy. I was shocked to see my account at -$365! I scrolled through my charges in utter horror, trying to figure out what had happened! I had been very careful to check online to see how much money I had in my account as well as to check the "holds" section, being aware that banks will use that as a way to make you "overdraw" your account.

I discovered that, out of nowhere, when my account was at $178.54, the bank charged a whopping $105 in overdraft fees. My account was not overdrawn and, in fact, stayed in a positive $73.54! I kept looking at it it and trying to figure out where that $105 came in. This, of course, made my account so low that all my purchases for Christmas quickly ate up the paltry $73.54 until I was at a zero balance, at which point they began to count every purchase after that as overdrawn. I calculated all my purchases and saw that, had they not charged me that mysterious $105, I would have had enough money in my account to cover all my purchases except two very small amounts (I must have been off somewhere in my calculations while spending). With those two purchases, I would have been overdrawn a maximum of $70. It's still excessive but much better than $365.

If anyone knows of a lawsuit against this bank, please let me know. I'm going tomorrow to see if they will fix this/explain this to me, but I'm not expecting much from what I've read here. If they don't undo this, I will be getting an attorney.

I went into BOA to the ATM to deposit a check. It was a check that was in my fiancee's name. We overpaid on our truck insurance and were refunded. I at the time had the account in just my name. She endorsed the check and I deposited the check. Unfortunately, being in a bit of a hurry, I forgot to endorse the check. Had we gone to the regular teller, she just would have told me that I needed to sign the check. Anyway, the ATM took our check and the deposit was completed. The next day the check cleared. We were able to access our money without any problems. I had every reason to think I made a normal transaction. At this time, I wasn't even aware that I had not signed the check. I was never notified of any problem. It wasn't until a week or so later when I went to check my card balance by phone that I found a problem.

When I called, it said my account was overdrawn by a ridiculous amount of money - over $800,000. So immediately I called customer service. The woman accessed my account and told me that it was closed. When I asked why, she told me that it was decided that it was to be closed and that there was nothing I could do about it. That was it. I was shocked and didn't know what was going on. I was never contacted by BOA that there was a problem. About two days later, I got them back on the phone and demanded to talk to someone about what happened. I was finally given a little information that it had something to do with a third-party check. I was not given any further info at the time. I am a father of four daughters ages 11 to 17. I am in the home construction business, and due to the bad economy I was recently laid off and have to collect unemployment benefits.

I have lost almost half of my income due to the layoff. I am the sole provider for my girls, so right now every dollar counts. We only had $68 after our bills to get to the next unemployment check (two weeks away). Without trying to contact me that there was a problem, they froze my account and we were left with no money and no full explanation. I went into the local branch where I opened the account along with my fiancee of 18 years and mother of all 4 of my kids. I explained the situation to the bank rep. She looked into it and it was at that time that I found out I forgot to sign the check. We explained what we thought was a simple mistake and informed them that I was supposed to cash the check that nothing illegal had taken place. They told me that because I had opened the account recently, I could never open an account with them again. We filled out a statement at the bank and had it notarized at the bank. We had the letter faxed from the bank to the main office.

I was told I would get my money back in about a week - no money. I called several times and spoke with several reps. All they could do was to say to put an escalation on the account (whatever that means). One rep told me my paperwork was received. Two more weeks passed - no money. The last time I called a rep told me that the paperwork had not been received and had to be re-faxed to an internal number that I could not be given. It made absolutely no sense. I wanted the number to make sure this time it was received and was told to take it back to the same person who sent it wrong to begin with. Is it just me or are they playing games? BOA has no regard for the common working-class family and I am disgusted. It has been 2 months now and we still haven't got anything back but a hard time.

My daughter has a CampusEdge Checking, on which I am on as well. She was away for the holidays and had some overdrafts. The first was for .12 cents, the second was a debit for about $6.00, and the third was for $6.00, which made the total overdraft at the end of the business day around $12.00. I transferred fifty dollars when I saw this.

The next day, she was hit with 3 overdraft fees totaling $105.00. I called the bank and asked for a refund based on my relationship with the bank. I have been a customer since 1995 and have several personal as well as business accounts. I also told them I thought it was theft to charge $105.00 for an overdraft of $12.00. I thought that BOA had put a stop to this. They informed me they could not charge the overdraft fees if it was under ten dollars. But they were charging a fee for an overdraft of .12 cents and $6.00.

I was given to a "supervisor," who was rude and asked me "Why should the bank take responsibility?" Well, I was angry and hung up before I thought of asking him why I as a taxpayer have to take responsibility for BOA in giving them a bailout. But anyway, I went online and chatted to a representative who gave me 2 of the overdraft fees back, because really it was the moral thing to do. Then, I see another pending $35.00 later that night. So I called, and the rep would not tell me what it was. She said I needed to call back in the morning. I knew what it was. It was another fee, because the two fees they were giving me credit for, which would post the next morning, had caused another overdraft.

I called the next morning (on the chat), and the rep either couldn't or wouldn't understand that I had not overdrawn my account but they did. She kept insisting BOA does not access fees on bank charges, but I showed her that's exactly what they did because if it had not been for the fees, they should never had charged in the first place and that they were giving me back. My account would have not been negative but up by $70.00. She just could not comprehend it. So, she left the conversation and just ditched me.

I called on the phone and got someone who at first could not grasp the logic of what I was saying. But after we went through the debits and credits together, she finally understood that the overdraft was not done by me but by BOA. She said, "We gave you the two fees back, because they were charged for overdrafts under ten dollars." I said, "Yes, and if you had not incorrectly charged them, this would have not overdrawn my account thus resulting in you charging me again." She agreed with my logic and refunded the fee.

I can tell you what is going on with BOA. I worked for BOA for nearly ten years. They used to stress customer service and common sense, looking at customers relationships and taking a personal interest in them. They started weeding out the "old timers" by asking them to become salesmen instead of tellers, demanding unrealistic quotas from them and in general making it miserable to work there. I did not quit because I couldn't meet their demands, because I did meet them and then some. I quit because they started wanting us to stop "thinking" and treat people like crap and con them out of their money. They bring in these new tellers, whom they have trained to not use their common sense but only go by what BOA has told them.

Who cares if someone has banked with them for forty years? If they overdrew their account by $5.00, they charge them! It's ridiculous how people have become numbers and not individuals. Screw BOA! They are cons and thieves. Put them under and take your money somewhere else where logic and common sense are stressed as important tools when dealing with customers! They are a bunch of mindless idiots there!

I have been a customer of BOA ever since they began business in New Mexico about ten years ago. I noted on a Friday that my checking account was overdrawn by about $50.00. I had an unexpected ACH loan payoff transaction that I did not expect. I figured that the overdraft was caused by one transaction since all of the transactions that occurred on Friday were large. After work, I went home and made a cash deposit to an ATM machine that more than covered the overdraft. The receipt from the ATM indicated that I had a $200.00 positive balance. I thought everything was OK.

The following Monday, I noted that I had 4 overdraft fees of $35.00 each. I called BOA and they indicated that I had made my deposit after the cutoff time for that business day (which they say is 7 or 8PM, depending on who you talk to). The four transactions causing the overdrafts all occurred on Thursday with a debit card, which usually means that the money is removed from the account immediately. If this had happened, there would have been only one overdraft transaction on Friday instead of four.

In any case, I thought the new ATM machines that automatically count your cash meant that a cash deposit would be credited to your account on the same day that it is made regardless of the time. Not so, they still have an earlier cutoff time even for cash deposits at an ATM. I called BOA and they, of course, refused to remove overdraft fees. I'm working my way up the line, but I am not hopeful so I guess I will find myself another bank. You would think that BOA would be a little concerned about their image, but they just want to make as much money as they can so they can pay back their bailout money and get back to their executive bonuses and perks.

I am disappointed that I am writing this second and final letter because of a ten-year plague, greed. This ten-year plague started with my identity being stolen by yes, unfortunately, my sister. You see, in December 1998, my sister tried to buy a car in her own name and was denied. Because of her desperation to have a car for work, the car dealership used my information without contacting me verbally nor did they contact me in writing. I did not sign any papers or give my sister or anyone else written or verbal permission to use my information. I began learning of the identity theft about March of 1999 when Sun Trust employees would call and write threatening letters (all this is documented in the first letter dated February 2008).

You see nothing but greed has caused this ten-year plague to fester in my life. I have long forgiven my sister for her desperation and greed. However, the slick car salesman was well aware of and enabled my sister to use my identity. He knows I was never at that rundown dealership purchasing a broken down used 1995 Mazda. I only purchase new vehicles. It was his greed to receive a commission for selling garbage to a consumer. Then there is the greed of the car dealership who needed to dump inventory before having to pay extra taxes on overstocked/unsold inventory. You see the owner or a supervisor also allowed the theft of my identity because I was never on that dealership's premises. I was where I am right now, in Fort Valley, Georgia. I bet if I look at my cancelled checks, I will find a copy of a check I wrote here in Georgia the day the papers at the dealership were signed. I also know a handwriting expect picked by you who would say that it was not my signature. I wish I could say the plague stopped there but it was clearly greed when Sun Trust financed the car.

Sun Trust knew who paid the late payments; they knew when the car was financed. They knew where the car was in Florida and everything about the car. Judith ** of Sun Trust would call and write me about my sister making non-payment or late payments. From my very first awareness of information about a car bought in my name, I stated verbally and put in writing all this was done without my consent. These past ten years of dealing with this plague has been an experience I would not want anyone to have to deal with - it has been extremely annoying and painful.

Sun Trust tried all kind of Mafia tactics to scare, intimidate and break me down. They wrote me threatening letters (included in the February 2008 letter). They called, harassing me on the phone - I have recently located my phone log. I documented in 2005 62 calls between August through December. I will enclose a copy of my phone log with this package. Through the ten-year plague, they mostly threatened to mess up my credit report, turn me in to IRS, and one time they had the audacity to call me at my job. I thought it was an emergency medical call about my mother who at that time was hospitalized. That was a time that I was not very cordial to them. Sun Trust even hired professional firms, Vengroff, Williams & Associates Inc, also Douglas, Knight, & Associates Inc, to perpetrate fair debt collection practices. I must have said this 988 million times for the last ten years, I did not purchase a car in Miami, Florida!

Then the Goliath, greedy Wachovia Bank, entered into my life. I guess greedy Wachovia thought they could squash me, a small town individual. What I have learned from this ten-year plague is that greed is Wachovia's motive for existing on the planet. I see why you lose class action lawsuits. You try to bully small town Americans. I won't lie and say that I was not afraid of you. About seven years ago, I began experiencing anxiety attacks every time something came in about my identity theft. Then I learned to face the monster, stand up to the monster and fight back. That's why when you, Wachovia, acquired Sun Trust and decided to attack me and make me pay for my identity being stolen and about $5,995.00 on a car that was repossessed in 2001 or 2002 and resold - you did not know who I had grown to be, a survivor. What does not kill me can only make stronger. That is my personal motto.

It was your blatant threat to turn over information to IRS that made me mad and forced me in February 2008 to write BBB, OCC, IRS and all others I sent copies to in 2008. BBB and OCC both wrote me back and said that you said you were going to settle and clear everything up. Well they, BBB & OCC must believe in legends, myths, and fairy tales. I believe in only what my eyes see and my ears hear.

BBB, OCC, IRS, and others, I hope you are still reading because my ten-year plague caused by greedy Wachovia Bank is still going on as of today, December 20, 2009. Greedy made and acted out their threats to me!

Threat #1 was when greedy bank, Wachovia, said they would mess up my credit and they did, by placing negative information on my reports. I know they told you, BBB & OCC, that they would remove the information. My 12-year-old niece googled me this week and questioned me about when I ever lived in Florida. I have always lived in the state of Georgia. That let me know that Wachovia, the greedy bank did not do what they said they would do. So I am happy to say I did not and will not sign that claims release form; I claim and I blame Wachovia for this ten-year plague!

Threat #2 was when greedy bank, Wachovia, said that they would turn in financial records to IRS - and they did! You see IRS contacted me in August 2009 and said that I owed IRS $988 for tax adjustments in 2007. Wachovia said that I did not include $5.995 income increase on my taxes for 2007. The reality is that since I would not be intimidated into giving greedy bank, Wachovia, $5,995, they turned in false documents to IRS, another greedy blood-sucking leech. I know I am not the only person on the planet that this bank has persecuted - I thank God for class action lawsuits!

Now I spoke with an attorney and he advised me to send IRS all the information I had disputing the claim but don't send any money. I sent the February 2008 letter with all the enclosed documents; however, I did enclose a certified check for $988, fear of IRS. I thought surely IRS got a reader who sees my ten-year plague and they will return my money. I waited and then I called and spoke with an IRS representative - I don't remember the male's name. All I recall is slamming down the phone because he said that I would not get my money back! Then on December 17, 2009, I received a certified letter telling me I was not going to get my money back; I owed the $988.

I cannot understand why! Wachovia, greedy bank, you were able to pull off one last scheme of total fraud against me! When you could not force me to pay for my identity being stolen, you hurt me by submitting false documents to IRS.

IRS, you fell for a lie. The car was repossessed and resold in 2001-2002. Wachovia and Sun Trust both have written that car off as a loss on their corporate taxes. They waited at least five years to inflict more revenge! How is this possible in a democratic society - oh I know, Corporate America - mega banks and businesses call it Fair Debt Collection Practices! Lol, I am truly laughing!

IRS, don't you think for a minute that I am going to allow you to keep what is mine. Since you are following up on me, go look back at all my other tax returns, especially look at the year I had to pay. My great aunt Bessie filled out my taxes that year and I know she made a mistake. So you need to calculate and include all the interest you owe me and everyday you keep my $988, holidays included, I am calculating interest. You see so many small town Americans like myself automatically grow up to fear the all powerful IRS. I used to fear you until lost respect for you.

To resolve the problem I demand that Wachovia immediately stop and cease this ten-year plague and raping of me, that Wachovia make all corrections to my credit report and evaporate from my life; all traces of me living anywhere other than Fort Valley, Georgia are to never appear by my name, repair and correction to my tax records with IRS. Don't even attempt to try and connect my sister to your impending downfall Wachovia. You caused all this because of your insatiable greed!

New laws and/or regulation guidelines must be implemented to protect small town and all Americans from this type of unfair debt collection practices! IRS, review and refund with interest all money illegally taken from me, etc., etc.

I do not look forward to hearing from you and nor do I expect you to adhere to the resolution of this problem. I will not wait for another minute before I hire my own personal team of lawyers. Please do not waste my time contacting me at the above address or by phone; I will see you in court in 2010! You have done all you can do to me at this point and time! Now I am standing and fighting back!

I had 2 charges on my account from a company I didn't authorize and had not even heard of. So, I tried to do a fraud claim because at the time the charges were presented, there wasn't enough funds in my account to cover the company's charges. The bank charged me two $35 return fees for this. I spent several hours on the phone with BOA being bounced between different departments with the bank. Finally, the 6th person I spoke with was a supervisor. She was very unsympathetic to my situation and kept stating that if it wasn't bank error or I couldn't prove it was fraud, the fees taken out would stand. She also stated I should contact the unauthorized company again and get the money from them, which I knew wouldn't happen.

I was lucky they cancelled the account without any fuss. These fees have gotten totally out of hand. I've been with BOA for many years so I didn't want to have to start over with another bank because I've already established a relationship with them. Also, I'm a veteran on a fixed income right now, so these 2 fees put a big dent in my budget for this month.

I was just charged a $35 overdraft fee on an account balance of -$4.10. This fee was charged to me after the new laws were implemented regarding banks and overdraft fees. Bank of America overdraft fee policy is as follows: "An Overdraft Item Fee is charged when you write a check or make a withdrawal for an amount that is more than the balance in your checking or savings account and we pay the transaction. You are not charged Overdraft Item Fees when we determine your account is overdrawn by a total amount less than $10 after we finish processing for the day. When we determine your account is overdrawn by a total amount of $10 or more, you are charged a $35 overdraft item fee for each overdraft item."

After processing, my account totaled a balance of -$4.10 and I was still charged a fee. I just spoke with Bank of America and to my dismay, they will not credit me back this overdraft charge. I have no idea how they are getting away with this. Hopefully, people speak out to this. It's wrong to prey on the poor and then claim it's the customers fault.

BoA apparently is allowed to call our home number because my wife has a checking, savings and credit card account with them. They have been calling at least 4 times a week with offers of various services that we've declined. The calls have been so numerous that we've asked them not to call anymore. We started out asking politely, and then impolitely. Last time I answered their call, I cursed a guy out before hanging up. That stopped the calls for almost 2 weeks before they started up again.

Now, I'm in a position to have to change my phone number just so that they won't have it. There doesn't seem to be any recourse for me to stop the harassment. To be fair, I've made the mistake of previously donating to charities who have called my home number, and I can't get them to stop harassing me either. So changing my number actually solves more than one problem. However, I consider my home phone a convenience for me; I don't have it so that I can be contacted by phone solicitors. And I shouldn't have to put up with calls I don't want to receive especially after asking them not to call anymore. And I shouldn't have to fill out a ream of paperwork or spend months trying to get out of someone's system.

I wish there was someone who would be responsive to complaints. Going from one complaint website to another may spread the word, but in the end I still have to go through the hassle of changing my number and getting it to the people (and businesses) who I trust to have it.

Bank of America decided to close my account after only a month of activity. I opened an account on 11/06/2009 and it was put on hold and frozen on 12/10/09. The reason? The same reason I shouldn't have been able to get one in the first place. I was reported to Chex Systems back in October of 2007 for an Arvest account that I made right but had inappropriate activity. Doesn't that sound like I was running some slave trade operation and using my bank account to misappropriate funds?

I was reported again in November 2008 for my Signature bank account. This was a charge-off account that I didn't make right, mostly because it was a majority of fees from Signature continuously running a $300.00 rent check through more than 8 times. Before I finally said stop. Anyway, it's still my fault for letting it continue. I filed for bankruptcy, chapter 13, end of July and had a meeting of creditors beginning of November. I have been paying on it since October. The bankruptcy hasn't yet reported to Chex Systems to take care of these.

On December 10th around 10AM, I logged into my bank account to verify a posting of my paycheck and balance my account. I do not receive paper statements. I had a balance of roughly $760.00 and $50.00 in my savings. I had been saving to purchase an iPhone and was also verifying the funds. That same evening, I went to AT&T to purchase my phone. My debit card wouldn't process. I had been having issues with it with some online purchases and asked the customer service rep if I could use the phone to look at my balance online, thinking maybe some money hadn't officially posted yet. I was unable to log in. Thinking it was my inability to operate an iPhone successfully yet, I asked if I could write a check. He agreed and the transaction was completed.

The following day, December 11th, I tried to log into my online bank account to double check the account to see what may have caused the issue the evening before and if I should just have BOA issue me a new debit card. Imagine my surprise as I couldn't log in because my password was inaccurate. Feeling more apprehensive, I called BOA customer service. BOA gives you balance information as you wait to talk to a rep. My balance information? -$8,000+. I immediately expected another hack, which I had suspicions of with the Arvest account and went for the Bank of America location where I opened my account.

The rep informed me that it was actually a hold on my account, that she couldn't help me and that I had to call the Risk Customer Service. I called and gave my information to the extremely irritated and unhelpful rep (I don't want to even call them customer service). He told me the reason for the negative balance was the $8,000 hold on the account from Signature Bank. So, I asked why Signature put a hold on my account. The rep said because I was reported to Chex Systems as a charge-off account with them and I would have to work that out with Signature. He informed me of three transactions that would still be posted to my account and any others that I had done that were not listed would be returned. But I had written two checks and purchased something from iTunes and eBay the night before that were not noted as pending on my history as of 12/11/09. They would be returned.

I requested to close my account and have them return my money to me. I requested the money in two money orders for the two checks and the rest in cash. But I left enough money in the account to cover the transactions that were pending on 12/11/09, plus an additional $15.00 as to cover anything that I couldn't remember that would be insignificant yet still come through. I could not close the account at that time because there were still transactions pending. I walked away with roughly $150.00 in cash and my money orders, and spent the whole afternoon of Friday the 11th trying to pay everything that would be returned.

I inquired about my balance with my savings account of $52.00 and they said they don't have a record of there ever being that much in there. I only walked away from that with $26.00. I also called Signature and spoke with an extremely hateful lady named Debbie, screw you Debbie and your evil attitude, who kept interrupting me without giving me any information. The only thing I did find out from here is that Signature didn't request the hold; they only had reported me to Chex Systems.

I spent the majority of my day calling several people at check systems, BOA and my attorney to find out what I needed to do and what's the reason for the hold, then eventual closing of my account was. I talked to 4 different people at BOA and only one, the final rep I talked to, gave me information that was helpful and steps I should take to find out more information on why they waited a month to close my account. He also informed me that it was not a charge to me, for the $8,000, that it was just a code they use to post money so that no other transactions can be posted. I inquired about notification. He said I was notified on the 10th by letter, the same day they closed the account at 2:00PM. It was only the 11th. Of course, I hadn't received notification.

I even called Chex Systems to get information from them on when the postings happened, what to do and why BOA would have decided to close my account. The rep at Chex Systems was also shocked that they would do this a month after I had opened the account, but advised me that all I had to do was have my attorney give them the BK information and they would notate that on this and that they would be removed because of the Chapter 13 Bankruptcy (Bank of America denied that this would happen).

Because I was reported to Chex Systems, I shouldn't have been able to open an account in the first place. I am considered a risk to BOA. That's their prerogative, they can do that. However, I gave them all of this information while signing up for the account. Because of my bankruptcy, I requested information from Chex Systems weeks prior to opening my account. I had all of this with me when I went to open the account and was told by the rep that they would see if it would validate and I had no problem doing so. I was granted an account without any information of being reviewed or assessed at a later date. Let me reiterate, my account was closed for the same reason I shouldn't have been able to get one, being reported to Chex Systems.

So Tuesday the 15th, I arrived at the BOA location to withdraw the rest of my money and confirm the closing of the account. The teller advised me there was no money to return and that I was actually -$68.00. I said I want to talk to somebody about this. She said, "Okay, go have a seat and the bank representative would be with you shortly." 15 minutes later, yes, 15 minutes because no one was available, the same rep who opened my account marched her happy butt out to assist me and another customer that had been waiting longer than I. She advised me that there is no longer a hold on my account but that yes, I am -$68.00. I asked for a statement and asked why.

After reviewing the statement, it shows that BOA let a transaction be posted on 12/14/09 from eBay and one from Bentonville Copy and Ship, plus an additional $40.00 was charged to my account from BOA for Account Research Fees. I asked the rep again why they would have posted stuff so late (the BC&S) that was showing pending on 12/11/09 and the other transaction $35.00 from eBay when they told me it would be returned. Can you guess her answer? I don't know, you'll have to call this number.

I stormed out without a second glance to call the risk team again. Again, extremely unhelpful, telling me I should have left the money in the account and that I will be charged overdraft fees, that BOA can chose to close an account at any time and can charge whatever fees they seem necessary. He also kept acting like there was a bad connection saying "Hello? Hello? Are you still there?" every 10 seconds. Remember, I am on an iPhone, static is never a factor. He said I kept cutting out and I said it's because he keeps interrupting me. My response verbatim, "You're trying to squeeze every damn dollar out of me aren't you? You couldn't collect on an overdraft fee on the account because I have been an excellent customer so now you got to invent ways to make a profit. You will never see this money from me." His response? He hung up on me.

Take my story for what its worth. Along with these other tidbits. There is no free checking with BOA, unless you have direct deposit or a daily balance of more than $1,200, they will charge you $8.95 a month. This is the cheapest account they have. Others require a daily balance of $1,500 and still charge you $10.95 monthly for having an account with them.

Keep the change transfer - Great idea, round up everything in your check book and BOA automatically transfers change to your savings. Possibly accurate except I'm missing $25.00 from that.

Referrals - I used my friend Scott as a referral, filled everything out for him and I to get $25.00 referral fee. Neither one of us has seen that money.

Debit cards - Make sure they all work. I opened my account on 11/06 and had a temp card and 2 permanent cards (the final one still not working properly) since I had my account. All these issues with the security code, expiration date, etc. and nobody could tell me why.

Bailout - Bank of America didn't need the bailout but had to receive it. I don't believe they have spent their limit of $87 billion. But seeing as all fees are strictly profit to Bank of America, why would they? If I owe them, let's say $50.00 in fees and they have a million customers or ex-customers that owe them $50 for frivolous fees, that's $5,000,000,000 in profit for BOA (Bank of America made $2.4 billion in 2009 2nd quarter profit).

Newsworthy - According to **, they spent "$1.5 billion in lobbying, they were a recipient of $45 billion in taxpayer bailout money from the Federal Troubled Asset Relief Program and have worked to sway lawmakers on more than two dozen pieces of legislation in both the house and senate. The Charlotte, NC company wants flexibility on spending the bailout funds and also wants to fend off restrictions on executive compensation, home mortgage lending and credit card fees. The bank also is lobbying on a consumer rights bill, on student lending issues, on a bill that would've allowed bankruptcy judges to alter mortgages and on a proposed federal regulatory oversight agency."

I advise anyone who has an account with Bank of America to scrutinize every single detail. They'll stick it to you somehow if you're not careful and it may be when you're in desperate need of a reliable company dealing with your money. They'll take it in a heartbeat and will tell you they have the right to.

We recently found out that B of A has a policy on returned checks. In the past 3 years, we have been customers of B of A. We have had 6 returned checks for various reasons, nothing intentional and we always resolved the charges with in 24 hours. Well, on Friday, December 11th, 2009, I went to the grocery store to get our 2-year old daughter some milk and bread and my card was not authorized. I called the bank and they said they could not help me. I would have to call the Risk Management Dept.

After being on hold for 10 min., a gentleman by the name of Jay answered my call and advised that our account was closed due to a returned check on my personal savings account. This account had no attachment to the account our debt card was linked to. However, since my social security was linked to all these accounts, 2 savings and a joint checking, all will be closed. He was extremely rude and treated me as if I were stupid and my money and being a customer didn't matter. I asked how I could receive the money that was in my now "closed" account and he said, "Well there isn't that much and I don't have that information available."

I could not accept this and asked to speak to a supervisor and he said that he would not transfer me as they cannot do anything for me and that I needed to accept my account is closed and I would have to call back on Monday to find out about my money. I asked if our conversation was being recorded and he said, "well, of course." So, I asked him to repeat that he was refusing to allow me to speak to a manager and/or supervisor and he said. "yes, I am refusing." I went on to say that I could not accept this and just say okay. However, there was nothing else he was willing to do for me.

The local branch could not assist me either. On Monday my fiance, Jess the additional holder on our joint checking account, called the Risk Management Dept. and spoke to a woman named Jessica. She advised Jess the same information about why our account was closed. He went on to ask how we could get our money and she said that the money will not be sent out until the 29th of December. He went on to say we have a daughter and bills to pay and now that our account is closed, the automatic bill pay will be returned and we will occur fees. He asked if B of A will be responsible for these fees and she said, "No, we are not responsible for any fee occurring due to the immediate closure of our account." He asked why we weren't informed prior to the closure and she said they didn't need to notify us prior. She was rude as well and very short with her answers and refused to answer most of the questions we had and ended up disconnecting the call before they were finished.

Even with billions of dollars of taxpayers' money, Bank of America (BofA) thinks it is right to overcharge the same people who bailed them out recently. For example, BofA, instead of paying the charges as they come, reshuffles them to cause the highest to be at the bottom while leaving the tiniest on top so that multiple overdraft fees may be assessed to the account. In addition, they reassess all the charges only 5 days later, meaning you may end up paying up to $70 of overdraft fees in about a week for just one dollar overdrawn.

To top it off, I called their so-called customers service on December 11th, 2009 at 7:25PM and spoke to Jeff, who was actually very helpful in disclosing some of the BofA practices, mainly how the bank handles the charges. Jeff suggested that I call in the morning and speak to a supervisor who has the power to reverse these unfair charges. But he quickly added that most often than not, they will not do it because it takes away from the bank's overall profit. I called the next day, December 12, 20009 at 2:06PM, and a quick conversation with Chris proved that the bank is very adamant in its ways even if it is wrong.

As I asked for a full name and an employee ID, Chris simply retorted that they do not have an employee ID and he is not required to provide his full name to me. When I requested to speak to a supervisor, he quickly added another woman on the line. I then reiterated my desire to know who I am speaking with. I requested that she identify herself with her name and employee ID if she has one. But to my biggest surprise/disappointment, the lady flatly rejected my request by stating "I am not at liberty to provide that information to you."

Now, here is my question to anyone reading this note: what reputable company does that? What good company only employs people with one name? What honest company promotes or hires people with no names? What sincere company gets bailed out for reckless practices and tries to fix it with unfair practices? Can someone, anyone provide an answer? I need the charges to be reshuffled in the order received by the bank, no refunds necessary.

On 12/11/09, I went to deposit a check through the ATM. It said my card was not valid. I went inside the branch and was told to call the Risk Department. I immediately called and the representative I spoke with was rude and had a nasty attitude when I asked why my account was closed. She stated that Bank of America has the right not to disclose why they closed it. I have never had NSFs. I don't use checks and I don't have overdraft protection mainly because of my low credit score.

I find it disturbing that Bank of America treats their customers this way. How they manage to keep customers is mind boggling. When I went back to the same branch to speak with a representative, there was a gentleman complaining because he had one NSF and they closed it without notifying him. And I watched as the bank rep offered no apology and no explanation and printed out some forms and he was told to call the number probably the risk dept where he would get no answers. Bank of America is an evil corporation. I strongly advise to do research when consumers choose to open an account with a bank.

A check written on the wrong account came in 4 days after my $3 and $2.56 transactions. I was charged $90 for all 3 transactions. The bank processed all three transactions at the same time (placing the larger of the transactions first) thereby overdrawing the account for all transaction. After speaking to the representative, I was told they could do a $10 courtesy refund. What a crock! $10 is not a courtesy. It is a slap in the face. I would never recommend this bank to anyone. They are not people-friendly. Every transaction is to benefit the bank. They do nothing to earn the loyalty of the customer!

I am writing this on behalf of my mother. I am her daughter and have power of attorney for her. On December 3, 2009, funds were deposited into my mother's Bank of America account. These funds were from the U.S. Treasury for Social Security and small annuity payments my mother receives from my father's retirement who died in January 2009, and a small pension of hers. These funds were placed on hold on December 4, 2009 by Bank of America. After trying to pay bills of my mother and not being able to do so, I called the bank's 800 number and found out that she had a balance of $0 and cents.

I contacted a representative of the bank and explained the situation. I was told that the bank had received a court order to seize the funds and I was given a contact number of the garnishee's representative. I explained that these were social security funds and that my mother depended on these funds. I contacted the garnishee's representative, a law firm. The law firm representative told me that they would release these funds once verified by the bank. The bank then told me they would remove the hold once verified by the attorney. I have been going back and forth and there has been no release of the funds. The bank also told me that anything that comes through the account will be charged bank fees against my mother's account. I have been told that these funds cannot be taken from my mother.

I must tell you that the garnishee is Bank of America and my mother's account is at Bank of America. Today, December 10, 2009, my mother's account is still on hold by the bank. I have called the bank and requested to speak to someone in the legal department on numerous occasions and have been told that Bank of America does not allow the consumer to speak to the legal department. I feel that this is an unscrupulous behavior by both Bank of America and Gamache & Myers against an elderly woman, who is on dialysis with congestive heart failure and early stage dementia. I have handled my mother's accounts since last year. I have power of attorney for her and I have given it to Bank of America in person and by fax on two separate occasions.

When I contacted Bank of America regarding this issue, my power of attorney could not be found by the bank. I feel that my mother is being mistreated and that the bank is holding her funds because they are in control of her account, which is not fair by any means. This is our complaint against Bank of America.

I made a deposit in my personal checking account on 12/7/09 through the ATM. Two checks were made out to my husband, which he signed, and one was from my son written out to cash for my daughter who babysits for him. On the 8th of December, I was checking the account and noticed that it said deposit adjustment. Two of the checks had been removed from my deposit and debited from the checking account. So I emailed Wachovia online. They said two of the checks had another party's name on them and they could not deposit them. Keep in mind that I have had this account for 5 years and have done this every week for the last five years. To make matters worse, my husband had me make a purchase for him using the funds and pay three bills for him. So with all of this in mind, they have returned the checks; NSF charged me $140.00 and can't tell me where the checks are that they removed from my deposit.

I have called the branch manager for the last four days and he will not return my calls. I have gone to a branch to try and get help, and all they tell me is it is their policy not to deposit checks unless the name is on the account. I said really, I have been doing this for five years and it has never been a problem until now. They told me, "Don't know what to tell you, but can't help you." Making matters worst, I made a deposit on the 8th before 2:00 with a check in my name in my account. They held the funds until today, returned two of the checks again and charged me another $70.00. They say it is their policy to hold deposits for 48 hours. So even the checks that I deposited that were in my name to cover the checks I had outstanding, they held on to and sent them back NSF.

Way to go Wachovia. You all have to be the richest bank in the world with a license to steal. So I have filed a complaint with the Federal Reserve and am waiting for a call back from a police officer to file a police report for grand larceny and fraud. As far as I am concerned, they stole my checks. They can't tell me where they are and they fraudulently stole money out of my account to cover NSF fees that I should not have been charged. Since the branch manager does not have time to call me back for four days, maybe he can take the time to talk to the police when they get there.

Calling them is a waste of time; the answers are ambiguous. I requested a "payment sate" and they say any day, the next few days, by your next statement.

My last payment was November 5th although I returned my information within 30 days, although their communication states 45. There are more little things like not telling you which documents to send or any details which would minimize delays to the process. I am enrolled in the plus and deluxe program. They pulled the two checks from the deposit and adjusted the deposit. I had four outstanding checks that I had written for him to pay some bills. Now, keep in mind that he just closed the business account with them because they would not deposit checks that were written out to him when he tried to deposit them into his business checking account. So to make a long story short, they took my checks and now, they won't find them or tell me what happened to them. I have been with BOA for over four years and during that time never had very much trouble with any overdraft fees because I had a good paying job and a high balance most of the time. However, in June '09, my father came to live with me and the hours I worked did not allow for the care he needed from me. So, I ended my job in hopes of becoming self-employed out of the house. I took care of all the moving around to get him settled here in Henderson, Texas, including opening an account with BOA for his own retirement transfers. He still wanted to keep his own check register and I monitored his accounts online regularly.

Then, one day he asked for certain things from different stores in town. We made a day of it. Even though he was still able to get around, he can't walk for very long so each time I went in to make a purchase for him, he stayed in the car. I gave him the receipts for him to put in his registry when we returned home. In total, I made 6 purchases for him that day using his debit card. A few days later, when checking our accounts, it showed where he was overdrawn prior to those purchases and each one had generated a $35 fee.

I called for an explanation as to why the purchases were allowed to go through if there were not sufficient funds to pay for them to begin with. I was told it was "a courtesy" extended by BOA to save me from embarrassment at a counter and to avoid a merchant fee for any returned checks. I pointed out that it didn't seem very courteous to do such a thing without any notification until after the fact and then to charge such a large amount, $35 for each one for a total of $210 in fees alone.

I must say that I know the branch manager at my bank's location because I had been working as a General Manager at one of the local restaurants that banked at BOA as well. I explained to her that neither I nor my father was ever aware of such a thing and that, for me, the best courtesy would be to stop the purchase beforehand in order to let the customer know there was a problem, maybe an error in the check book or a miscalculation somewhere. And as far as merchant fees are concerned, I wasn't writing checks; I was using a debit card. She agreed to remove the charges after an extended conversation on the insanity of such a policy, or at least the insanity of not bothering to clearly advertise such a policy.

I'm sure it's in the fine print somewhere but I believe she saw the truth in how this had happened and the seemingly underhanded nature of it. I asked to have the courtesy removed from our accounts so that no purchases will be allowed unless there is sufficient funds to pay for it. Part of the problems with our economic fall in the recent year is due to people spending money that don't really have to be spent and I do not want to contribute to that.

Since then, things have been a little shady. I saw a program recently on Frontline that talked about how these courtesies first came about (as a way for banks to offer "free checking" and still make money, more than they were making before). They spoke with someone who also mentioned that banks have computer programs that will move charges to an account around in order to justify a service fee. I'm here to tell you that it must be true.

Here's an example: I transferred money from one checking account to another and made a withdrawal of $80 that same day at the ATM. This would have left about $25 in the account. Dell Inc, of whom I was in dispute with and which BOA was notified that any electronic transactions from Dell were not authorized by me, tried to push a revolving payment through (Man, that's a whole other story!). The payment was for $50. Instead of refusing the transaction, BOA's computer program accepted the charge and then credited it to the account before the ATM withdrawal.

So when you look at it online, you see the Dell payment hit the balance, taking it down to $50 and then the ATM withdrawal for $80 putting me $30 overdrawn and generating a fee of $35. I ask you, have you ever been able to go to an ATM and withdraw more money than you have in your account? How is it that the $80 went through when, according to BOA, there was only a balance of $50? This time I received no satisfaction in the matter.

I then resolved that it was time to change banks. I have recently started a new job and plan to make the move to a different bank as soon as there are enough funds for me to have a substantial amount in a new account and close the BOA one. Yet, today, this very day, I find that I have to fight with them once more. You should know that things have been bad financially for about two months but are now looking up.

On 11/7/09, I had $1.01 in my account. I needed to purchase a few things so I transferred $16 from savings which was made available immediately for purchases. I checked my account again online to be sure I had the money and then made three small purchases totaling $13. This all occurred after 8 pm on the 7th. I made no purchases using my debit card on the 8th. Today, 11/9/09, I went to my account online and find that somehow, the monthly service fee was applied prior to these purchases, putting my account in negative standing after two of those purchases and apparently about to generate two more fees each totaling $35.

So on my first day off in over 7 days, I have to get up and go down to my bank to find out why and how this happened. Here's what I already knew to be true. Any service or monthly fee they place on your account cannot trigger a $35 fee. However, if they apply the service fee first then the purchases, they can generate the fee. My question for them was this: how in the world did those purchases go through if the money wasn't there? They had no answer for that but were quick to remove any service fees that may be triggered. I'm glad they made the correction quickly but it also confirms what I have been wondering for awhile. This isn't the first or second time they have run into customers who have had their accounts flipped around so as to generate a "courtesy" fee.

Every holiday, my nine-year old son receives a $25 check made out to him from his grandmother. Grandma has sent these checks since he was born. Most times, I have cashed it and given him the money. Sometimes, I deposit it in our checking account at BOA and write a check to our son's savings account at Vanguard. Recently, I was told at the drive-thru window, that I could not cash the check for him. I had to have him with me or have him sign the check. The clerk refused to cash the check. I was confused and frustrated, not understanding the policy.

When I asked to see the written policy, the clerk said I could not have a copy of the written policy. I left upset. After picking my son up from school, I returned to the drive-thru. The same clerk returned the check to me and said my son had to sign the check since he was old enough to know how to write his name. I told her that she said I could have him with me and cash the check. She started to argue with me that she never said that. My son signed the check and received the money. I was able to contact the bank manager two days later. He agreed that it sounded as though it should have been an easy experience to cash the $25 check for my son. He did not actually know the policy and would have to look into the matter.

I received a call back 40 minutes later. He said the policy on third party checks is to verify that the check is not stolen or being fraudulently cashed. Technically, I am unable to cash a check for my minor son although for business reasons, he thinks I should be able to do so. He assured me that if I go to the branch where he spends the most time, I can have the check easily cashed. Really, I must change my normal routine, go out of my way to seek the bank manager out and then be able to cash my son's $25 check. My husband and I are our son's guardians and have legal power to set up money accounts, deposit and withdraw from them and enter into contracts on his behalf.

This third party policy is reasonable only when applied to adults. Our son is a minor with no legal authority. Our name and address are the same. We can provide documentation of our parentage. Why are we forced to accept a contrary and belligerent attitude from a bank teller when cashing a $25 check from his grandmother? I plan to open a checking account at another bank and transfer to it. This rudeness and frustration is not worth the long standing relationship we have had with this bank.

Attached is a copy of other fees that came up related to the mortgage error submitted by fax a couple days ago. In total, we need to receive reimbursement for a total of nine $35 overdraft fees. In essence, this is a total of $315.

Note: 10/30 spoke to Doretha in Payment Research who asked for routing number and bank# to refund $350 back into account within 72 hrs.

On 11/6, there was no refund yet. I called and spoke to someone in Payment Research who told me that the refund was denied due to invalid routing number. I repeated routing number, and the rep stated this was not what the last rep recorded. She said if the request was approved, it would be a couple of days. She took down my cell number and email address for someone to follow-up.

On 11/12. I called again. According to the Yolanda, the rep, noted approval. Timeline is Dec. 7. Then, I asked her to please transfer me to a manager to escalate my account and refund. After being on hold for 15 to 20 minutes as she tried to get payment research, she was able to escalate this to a manager at the corporate office. She stated that the only reason it was held up was for an incorrect routing number. Now that they had the correct number, it should be processed asap per her manager.

On 11/23, there was no refund to the account. I called again. The rep saw where the supervisor was going to escalate and research the issue but there were no results yet. I talked to Jrchaetta in Payment Research who reviewed the case and would escalate for a paper check to be cut (9:05 am). She stated she would call me back to give me status of when check would be cut. She was aiming for the end of this week by FedEx.

On 11/24, there was no callback. At 12:43 pm, John, a rep would not transfer me to Payment Research Dept. He stated that a new policy was for reps to talk to supervisor regarding contact first. After doing so, he told me that the supervisor would get a message over to Jrchaetta to call me back today regarding issue.

On 12/2, I called was transferred to Steve in Customer Service. I explained the issue and expectation of FedExed check. He told me it was not possible to receive a check last week. He transferred me to Payment Research to reach a manager. I was routed into a call with another rep and another customer. I could hear them, but they couldn't hear me. I hung up and tried again. First of all, about my financial situation, I work on commission so I never know what kind of salary I can get per week. It can be $1,000 or $300. With the economy nowadays, my paychecks are mostly $300. So here are my complaints. What's up with a $35 overdraft charge for a cup of coffee and adding additional $35 overdraft within 5 days? I need to pay a lot of bills and I cant be left with $70 on my checking account. I really don't think that this is legal, but the most terrible thing is that they treat you like criminals when you ask them to refund at least some of your money.

Because of my financial situation was really difficult lately, I wasn't able to pay my credit card bills in time. So, I contacted the customer service representative and she advised me to set up the minimum payment plan. I promised to pay every month as long as they don't close my credit cards. Now that my financial situation is somewhat better, I made $1,000 payment on my card, which left me to pay $500 more on my account. What was my surprise was when I learned that my credit card was closed without any notice. No letter, no phone call, nothing. I started to call the bank, got transferred literally 10 times, had to repeat my story over and over again, which was frustrating enough. In the middle of all that hustle, they hung up on me and I had to start all over again. No one could help me, so I decided to go to the bank personally.

I had to wait about half an hour to find out that they can't help me and the only thing they could do for me is to give me the phone number of customer service. After 2 hours of running around and being on the phone, they connected me to the credit company. The representative was extremely rude. He said that they decided to close both of my credit cards and when I asked what I can do, he said "Well what do you want to do?" I was so tired that I started to cry and said that it's not my fault that I didn't have any money to pay my bills. I explained to him that I was on the minimum payment plan and that as soon as my financial situation improved, I paid $1,000 on my account. He said that he couldn't help me.

I wish he wouldn't be so arrogant and at least give me some advice about my situation. Unfortunately, in my case, none of the representatives of Bank of America were willing to help me. They treated me like a criminal. I lost all my interest in dealing with them. None of their promises came true. They don't care if I have nothing to eat; they just want money.

When I signed up for my Wachovia Free Checking, they offered me a service called "Way2Save", which transfers $100 a month from my checking to savings. When this service was described to me, it sounded like the transfers would happen at a set time, so I could plan around them. This has never been the case.
The day before thanksgiving I made several small transactions with sufficient funds in my account to cover them. A hold was placed on my account for those funds, so the bank definitely knew those transactions were pending. Then the day after thanksgiving they, knowing I had a bunch of pending transactions, instead went ahead and transferred the money to cover those transactions to the "way2save" account, and THEN posted the transactions, resulting in me getting hit with $180 of overdraft fees. I tried using their online customer service to seek my money back, and I got a bunch of generic answers to questions I didn't ask, and no answers to the questions I was asking. At one point I was told I should use my check register to keep track of my account. I do use my check register. But I have no idea when they will decide to do the "way2save" transfers, so I can't account for that in my register. At that point I lost it and my reply contained a four letter word, and they sent me a message saying because of that they refuse to help me. So I went down to my local branch and spoke with the shift manager. He was more helpful in explaining things, but not in getting my money back. Apparently it's at Wachovia's discretion when, and even if, they do the transfer to the "Way2Save" account, even if there are holds on those funds. They also process higher denomination transactions first, rather than in chronological order. Thus maximizing the overdraft fees they can charge people ($30 per $5 to $10 transaction in my case)... And the part that no one can give me a straight answer on is why I still got the fees even though the funds to cover the transactions NEVER LEFT THE BANK.

Is it actually legal for the bank to take 17 days to clear my $1,500 check? It was a good check from a large business we deal with and the money was taken out of the customer's account on November 13th but will not be credited into my account until December 2nd. Today is the 1st and I have just deposited a further $2,000 check, which will clear in a week. In the meantime, 9 overdraft transactions accrued from standing orders and such, totaling about $350. One of the excuses given was that the Bank of America ATM on the outer wall of their branch was not their responsibility and I should contact the ATM directly? It was the bank staff who advised me to use the ATM to deposit checks to save waiting in line at the counter.

My small business can't survive being treated like this. Is this legal? How long can they keep and use my money while charging me overdraft fees and extended overdrawn fees?

Wachovia is now holding cash deposits made after 2:00 p.m., for 48 hours, before "processing". This means that the funds are available immediately from an ATM, but not available in your account toward any incoming debits like checks or online payments. They will charge an overdraft fee for a bounced check, even if that amount was deposited in cash the day before.

We filed a hardship claim with Wachovia in 2007 requesting assistance on a loan. As of Nov. 2009, the case is still unresolved. Wachovia has exercised every sleazy tactic they could dream up to get payments.
Over the last two years, they've harassed us, lied to us, ignored us, refused to return phone calls, lost documentation numerous times, and passed us to different departments all over the country. The latest conversation with them is that there is nothing they could do to modify our loan and will begin foreclosure immediately. This is the second time they've begun foreclosure on this loan. The first time, after months of harassing phone calls from creditors (at home and work) they issued a letter on July 1, 2009 announcing foreclosure. We responded by telling them to go ahead because we could no longer make the payments as a result of my husband losing his job. Additionally, I was in the hospital and could not negotiate with them. Anyway, Wachovia utilizes a program called 'Right to Offset' which is a banks right to go into any of your accounts (at their bank) and withdraw funds. They said we agreed to this tactic at some point during the 20 years of banking with them. The first time they did this, they intercepted my electronic payroll deposit which caused us to bounce numerous payments (house, credit cards, tuition, etc.) due to lack of available funds. Not that this was bad enough, we were charged heavy overdraft fees from Wachovia and the party receiving payments.... and, Wachovia NEVER even notified us that they were taking funds from our account!! Lack of notification is against the law. While still in shock, I called my local branch and was rudely told they were within their rights and there was nothing I could do. I was flabbergasted to say the least. Had I been savvier, I would have closed the five accounts I had with them at that moment; however, I naively gave them another chance. The second time, they withdrew funds from three of the accounts including my daughters personal college checking account. Again, we bounced numerous checks ...blah, blah, blah. This is the real kicker... after moving our checking/savings accounts to SunTrust, I began to make payments to them from the SunTrust account. When I fell behind again, they electronically removed the funds from our SunTrust account without our permission. When we discovered what had happened, they said they had spoken with us on the phone and we agreed to the transfer... and they had the conversation recorded. We instructed Wachovia to produce the tape, and in the meantime, we would file a complaint with the appropriate officials. Long story short, they returned the funds the next day, and apologized. So, if you are still banking with these crooks, I urge you to move your business elsewhere. Their misuse of power and perceived rights are ruining hard-working individuals’ credit, bank accounts, and savings.

It's beyond me as to how a transaction the next day can cause a negative balance. They told me that a pending charge had placed a hold on funds and to check my available balance history online. I checked the available balance history online and it showed no such hold on funds and verified the fact that they charged me for overdrafts when there were funds in the account to cover the transactions. They are unwilling to budge on this issue. I have taken screen caps of all of this and am sending to BOA legal to demand that they refund the charges. The bank gave me a temporary card and advised me a new card would arrive in the mail. A month passed and I did not receive a new card nor did I even recall that the card I was using was only temporary. I had gone out of town and tried to access cash on my card. A message was displayed saying my card had expired. If so, why didn't I receive a new card in the mail? The only other debit card that I had was my business ATM/check card, also a Bank of America card. I knew that if I accessed cash, I would overdraw the account; however, having no cash and being out of town, I had no other choice.

I accessed cash which overdrafted the account and also overdrafted my credit line on credit card in which the limit had just recently been reduced to a limit of $200 over what the balance was at the time. This caused overlimit fees to this particular account. Bank of America refuses to reimburse the fees for this entire chain of events. They say I had other choices. I could have called and asked them to transfer funds from my personal to my business account even though they are not tied to each other. Additionally and generally speaking, I believe that the way they list the order of transactions are in a strategic order that benefits the bank and causes more overdraft charges to be incurred. I am sure there are other bank customers who are noticing the same issues. I would like to find an attorney who is willing to investigate claims such as mine.

In the last 2 months, I have had two similar run-ins with this company. We are a small business and have one account with 6 separate card holders. My boss was preparing for a trip from Pennsylvania to Maryland for a convention and realized that he misplaced his card. Immediately he got on the phone to call Bank of America and got the lost card cancelled and a new card sent out to him the next day by air as he was definitely going to need his card for his hotel reservation. This particular hotel was insisting that he check out utilizing the same card the reservation was made with.

I was then instructed by my boss that his new card should be here at the office the next morning and to then to turn around and next ay air his new card to the hotel to his attention. So the next morning came and went and it was 12 pm before I really started to worry. I then called Bank of America and confirmed that the card was shipped and that everything was going as originally planned. I spoke with one representative that gave me a tracking number and said that everything looked good but for some reason, the tracking information was not appearing like it normally did and UPS should have been able to give me more accurate information.

At that point, I then hung up and called UPS who informed me that they have received notification to expect the package for shipment but nothing was actually shipped. Now, I was really upset that two different representatives had given us wrong information and I called Bank of America back again. I explained what had happened and was told by a supervisor that they were sorry but we were misinformed on two separate phone calls and the representatives would be coached. She went on to tell me it would be at least seven business days before the card actually ships and at that point, the card will come next day air.

What the real topper is to this whole scenario is that the supervisor was wrong also. I received the card the following day after I spent the previous night traveling 3 hours to bring my boss money for his stay at the hotel and eating expenses. Had any of the people I spoke with at Bank of America been accurate, it would have saved me six hours of drive time, fuel costs and my time and energy.

A few weeks ago, I got a call from my National Sales Manager who said he called B of A to check the available balance on his card and was told that they would be sending him a new card very soon because his current card had been "compromised" since there was an issue at one of the merchants he recently had used his card at. I then called in to Customer Service, waited on hold, verified all my account info, explained the situation and then got transferred to the Fraud Department to start all over again. I spoke with someone who told me not to worry about my salesman being out on the road and not being able to use his card and that his current card was active until November 22nd, 2009.

Today, November 19th, 2009, I received a call from my National Sales Manager who is based in Kansas (our company is based in PA). He is currently in Arizona demonstrating one of our machines to one of our distributors and his customer. Apparently he stopped to refuel his vehicle and got the a few bottles of water and his card was declined. How can that be considering I just ironed out this issue but 2 weeks earlier? I went through the entire process again and was told that they were sorry for the wrong information that was given to me but systematically there was nothing they could do to help me or the situation that my salesman was in. He went on to say that the card can still be used but that the transaction will have to be declined first and then the merchant will need to call in for approval. Oh yeah, and only select merchants have this capability. Okay, so now what? How does this look to our distributor and his customer?

So by that point I was fuming because we couldn't look less professional to our customers if we tried. I ask the supervisor that I was speaking with for an address to send a letter of complaint. He came back after leaving me on hold for a few minutes with an address in Newark, DE. I then asked him who they are governed by and his response is the FCC so I asked for their address as well. He put me back on hold a few minutes and came back and said he was mistaken and they are not governed by the FCC, that they are in fact governed by the Federal Government and he has no address or telephone number or any way for me to contact their governing organization.

This is unbelievable! This supervisor also assured me that the representative that gave me incorrect information would be coached and all I could do was laugh. I did tell him if they spent as much time training as they did coaching this issue and my previous issue could have been avoided.

On October 29th of this year, I went shopping to buy Halloween costumes for my family. After doing so, I filled up my gas tank and went home. On this same day, the business that rents my daughter's trumpet to us placed an automatic withdrawal for the rental fee of the trumpet. This transaction wasn't cleared until November 2, which would be the day they will receive their payment. So now my bank, Bank of America, has charged me two overdraft fees of $35 each for the Halloween and gas purchases because they said since the trumpet rental fee was pending and with the other two transactions, I overdrew my account.

On October 30th, I deposited over $300 in my account and on Nov. 2, the trumpet rental fee was cleared. So at no point did my account show I was negative funds because these transactions were still pending. When the fees were paid, there was enough money to cover everything. When I called Bank of America to complain about the fees, I was informed that because of the pending state of the transactions, I was overdrawn regardless of the fact that the money wasn't actually withdrawn from my account until two days later. To me this is stealing. When the funds were taken from my account, the money was there. Apparently, pending transactions are the same as cleared transactions. You must read the fine print!

So now I have a total of $70 in overdraft fees already taken from my account. I don't see how this can occur. How can a bank charge me overdraft fees two days before the funds are actually released? And why wasn't any of the charges denied since there wasn't enough money to cover everything? How can the banks get away with these crooked practices? Something has to be done. I don't know how this is legal, but I encourage everyone who reads this to stand up and let your voice be heard. This is wrong! They should not be able to assess overdraft fees until the day the money is paid out nor should they be allowed to accept charges on accounts that don't have sufficient funds to cover them.

America needs banking reform and we need it now. These institutions are running amok with very little regulations. Remember the mortgage crisis? People lost their homes left and right because of crooked banking practices. Congress is already cracking down on wrongful credit card fees, why stop there? We need to stand up and demand these banking practices be stopped!

I made a deposit of $122.42 into my personal account, so I thought. But through other transactions, I was handed a deposit slip for my personal account. So, I'm thinking the money is in my personal account, so we are taking money out of it not knowing we are over-drafting every time we're making withdrawal. So, we accumulated 6 overdraft fees at $35.00 each - times that by 6 equals $210.00. Also, we're charged $8.95. It was their mistake including $8.95. So, they refunded $140.00 but still charged me $35.00 because it was 5 days over the overdraft charges, which was their mistake. So since they were taking out fees, which I was unaware of, they should have refunded that money back. Then I wouldn't have been over-drafted again for the amount of $24.44, which caused another $140.00 worth of fees. All of these debits were three/two dollar debits: $12.50, $8.00, and $19.20.

I talked to people online and over the phone and in the bank trying to straighten this mess out. I deposited $75.00 and they refunded me $70.00. I asked the lady online what I needed to deposit so I would not be in overdraft. She said I needed to deposit $64.00, so I deposited $75.00. Sunday, I'm over-drafted again by $24.44. They had taken out another $35.00. So, I went in to the bank and deposited $50.00 and then went into where I bank at and wanted to know why another $35.00 was taken out. She said that it was 5 days over the overdraft limit and I did nothing about the overdrafts. I had talked to people over the phone and their supervisor; went online live chat. So, I think everything is taken care of from the 10-26-2009.

If they hadn't taken money out or made the mistake in the first place, I wouldn't have had any of these charges. She said it was partially my fault and I need to keep better records. How can they do this? It's so wrong. They are “rapings”. I told her that we have no money and so I know exactly the amount. She said I was responsible on writing everything down. How is that possible when they keep taking my money out? And then it shows up in 5 days and they're telling me I'm fine and so is my balance? They are almost fraudulent, deceiving and rude. They start from the smallest debit and start charging fees. I asked them for the time of debits and they won't give it. But they know exactly what time the large and recent debits are so they deduct them first which caused all of the $2.00 debits.

This is so wrong. They are robbing us. I'm not sure how many other times this has happened to us. Someone ought to make them have a time stamp of all transactions (hours and minutes). Then, there would be no debates on time of transactions. They should have never taken any money. They have refunded me most of the money; but I don't care if it's $5.00 or $35.00, it's still mine. But they refuse to because I was 5 days late even though I've been talking to people about the problems. It's not right. My husband called about foreclosure loan and the lady hung up on him telling him he didn't qualify.

First of all, it’s humiliating being told by them that it's my responsibility and were not being responsible; this is very stressful. Our work has been slow so every penny counts. I have lupus and chronic fatigue/fibromyalgia. This has been causing flare-ups, this is no exaggeration, and I have not been feeling well because of the stress of having to beg for my money back. It's taken me from the 10/26/2009 to today 11/16/2009 to get some of my money back, or most, from those dates. I've had a long fight. But boy, that is humiliating. I’m disgusted with the way Bank of America is raping us.

They were holding my claims check for 4 months. When they finally decided to release the claims check, Bank of America sent the check to the wrong contractor. I'm getting ready to sign a forbearance agreement, and the work is not done for the tenant to move in. They told me it will take several weeks for them to reissue another check. They said because the funds were empty. That is not true, because they have over $8,000 of the claims check (they only mailed out $4,000 [to the wrong contractor]). I have a tenant who wants the place for 12/01/2009; I can’t make my forbearance agreement. They are telling me the check won’t be to the correct contractor until after December. Please help me. I will lose the property because of Bank of America.

I was noticed that I was charged $280 in overdraft fees, which occurred because the bank opted to post from highest amount down to the lowest amount. When I contacted customer service regarding this matter, I was advised that I would be given a 25% refund for the fees for a total of $70. I advised the rep that is unacceptable as no where in the paperwork do they say this is how they post, I was transferred to a "supervisor" at this point. After being on hold for 15-20 minutes, i find out that Iw as blind transferred and had to start from scratch. I was also informed that this department handles fee refunds. I'm no genius, but if you have to set up a department solely for fee refunds, there must be a problem somewhere. When I told this rep that it it not mentioned in the paperwork that they post highest to lowest, she said that it is. When I asked specifically where it is located since I may have missed, I was told that she does not. My next question was if you do not know where it is located, how can you be sure that it is there? Iw as yet again offered 25% off, I told her that I would take that, but be advised that I am going to complain because this is ridiculous. If they in fact feel that this is just, why the need for the department and why the offer for a refund, no matter how minial?

We have made an offer and it was accepted over 3 months ago and we still haven't heard from BofA. This is, I believe, a short sale. A simple yes or no would be civilized at minimum. The home is located at **. The realtor is of no help. We realize there is considerable work to do on the house (fixer-upper). We wanted to get it done before winter rains and cold become constant.
