I had 2 accounts with MBNA and no problems until Bank of America took them over. I received notice of a rate increase on one account. I opted out and sent them my card cut in pieces. But I never received an opt out for the other account. The once $120 monthly statement went to $390 and is still climbing. I cannot tell you what the rate is now on the other account because I cannot get a statement from them. I have been calling, writing, filing complaints and the only thing that is happening is my credit report is being ruined. I have prided myself on keeping my credit in good standing. BofA is ruining me. I am a single mom with sole custody of two daughters and no financial assistance other than my job.
I am very scared. My credit is being ruined by a company that doesn't really care. Before BofA came into my life, it was under control. Now I have lost that control and the ability to climb out of this mess.

I received an Important Notice of Change in Terms for my Bank of America credit card account. I immediately called to inquire as to why my interest rate was being increased by 150%, only to be told that all BofA customers are receiving this offer and that it may be rejected. Of course, there is no form nor envelope included with the Notice to expedite the process of declining their "offer".
My damages are minute compared to the customers who do not take the time to read this notice or do not understand their right to reject this offer. My damages are limited to the time, materials and cost of a stamp in order to write and send a letter of rejection.

I recently was duped by the sliding due date scam used against auto-pay customers such as myself. HOwever, this most recent behavior has convinced me not to use BOA ever again!!! I accidentally paid off my entire credit card balance TWICE and confirmed monies were released from my banking institution and that BOA has received the money. I tried to call their customer service 2 weeks ago to get the monies returned to me. I was told that I would receive a check in 2 weeks.
I just contacted them to request status and was told that I had to wait 10 more days because it has not posted from the clearing house. This is obviously not true given my statement shows the credit of the duplicate payment. They are holding my monies hostage to draw the interest and will not return my money to me until after the 27th of this month.

I had an MBNA credit card for several years which was bought out by Bank of America. In September 2007 I received an offer in the mail from Bank of America stating a 3.99% apr on access checks. I used one of those checks and when I received my next statement the access check was assessed a 24.95% apr. I called and emailed customer service and they said that that was the apr associated with the check.
Unfortunately I threw away the paperwork that I had because I have never had that sort of issue come up with any other credit card company in the past. The interesting thing is that on all previous statements for the past 10 months the interest rate section of the statement shows a 1.99% apr, however I had zero balance in that category.
At the apr rate given I was charged $166 in finance charges. If I could not pay off my balance within a couple of months the finance charges would be horrendous.

I have been a B of A customer for several years. When I was laid off from my job last year, bills plus the cost of moving to another state for a new job, resulted in my accrual of approximately $17,000 worth of credit card debt. I ended up missing a payment by ONE DAY. As a result, my 14% interest rate was increased to 27% instantly, with no chance of switching it back.

Bank of America acquired AAA Financial earlier this year. I have a credit card debt with AAA - now Bank of America. I knew that my 1.99 interest rate was going up to 18.99 in May/07, but I didn't know that Bank of America had acquired my debt. I have tried several times to get my rate lowered with no success. But my biggest complaint is that their billing cycle is 27-28 days rather than 30. Sometimes I end up making 2 payments in a month. That is difficult when living on a monthly salary. I also just read that Bank of America has acquired MBNA. Great! They now own another piece of me! I detest this bank and would not recommend it to anyone.

BofA, MBNA increased the APR on my account from 14.24% to 22.99% with no prior notification. My account is not over limit or past due. When I asked when and why the APR% changed I was told that BofA/MBNA reviews your credit history every month and they dediced that my account balance was too high (although not at or over the credit limit)and that they sent me a notice three months ago advising that they had the right to change the APR. I never received such notice by mail, email or phone.
I was also advised that the account has an adjustable APR and that they can change the rate at any time, as part of the cardmenber agreement. In my opinion this amounts to nothing more that consumer theft and an extremely poor business practice. No other credit account I have changes the APR, especially without prior notification. After my phone call to them I opened a new Visa account with my own bank (Chase)and had the entire balance transferred to the new account at 0% interest. Even the 3% transfer fee is better than paying MBNA any more money.

I recently opened 2 credit card accounts with Bank of America. My payment was due on 08/16/07. My August payments I paid on 07/30/07. My next payment was due on 09/17/07 and I made the payment on 08/28/07. Bank of America charged me a $39 late fee(per card) for my 09/17/07 payment that was paid 2 weeks in advance. On 09/21/07 I called and they stated that they would waive the $39. I checked my statements online and they did do a credit for $39 but they still considered me past due for the September payment stating that my minimum payment due for October was my October & September payment and they still said I had to pay the $39 late fee. They stated that the $39 would come off of my principal balance. I have been dealing with credit cards for years and I worked for a credit bureau for 8 years. I have never heard of such a thing. I closed both my accounts immediately and transferred my balances. I had also asked the customer service rep if I could speak with a manager and he kept asking me why. I told him - have you not been listening to me for the last 20 minutes. Needless to say I was not able to speak to a manager.
Economic damage : having to pay an extra $39 on each credit card (that was waived) on top of a past due amount which I was not past due on. I am hoping there will not be a credit reporting on this. I strive and am proud to say that I am never late on a bill.

My last credit card statement showed a due date of 09/03/07, which is the Labor Day holiday. So, on Saturday, 9/1, I went online to make a payment. The online payment page would only let me choose a transaction date of 9/4, which is past the due date. I called BOA and a bored representative told me that I wouldn't be charged a late fee if I went ahead with my transaction for 9/4 because 9/3 is a holiday. So, you guessed it, I got charged the late fee.
When I called BOA, I was told that I was incorrect. Because of something she said, I knew she could see that I had called on 9/1 and gotten the opposite answer from another rep. She said that she would waive the late fee this time out of courtesy. She haughtily told me that I had plenty of notice to pay my bill and should pay it sooner in the future, and repeated that line when I suggested that BOA should program their statements to avoid federal holidays and weekends, when they cannot accept payments.
In reality, my bill was due on 8/31, since the following three days the company couldn't (or wouldn't) receive payments. I would have no problem with an earlier due date in this case. Of course, they won't change this procedure, because they are almost guaranteed a huge bonus from late fees whenever the due dates fall on a holiday. I am paying off the balance to BOA and looking for a better card.

I finally received the last straw recently as I noticed that 2 credit cards had been opened up in my name without my authorization.
There doesn't appear to be any fraudulent activity from an outsider, as one card has not even been activated, and the other is activated but has never been used. The guy on the phone said that I must have done it, as they would need all of my info to open the cards, but I know thats not true. This is a concern to me, as I am very careful about maintaining my credit and I like to only have a few avenues of credit. This has to be against the law.

I've been loyal customer to bank of america with 2 credit cards for over 5 years. I have never had a late payment on either of these accounts and have no other delinquencies on any of my credit. I recently closed my accounts with them in order to eliminate debt and lower my monthly obligations. Well, it turns out that they looked at all the other credit I have and based on the amount of credit I have outstanding they raised my interest rate 10%. All my other credit is paid on time every time and just because I have a lot of credit they raised my rate by 10%.
This is ridiculous and completely defeats my purpose of trying to eliminate debt and my monthly obligations by raising the amount I pay each month in interest to Bank of America. Their customer service was no help and they could not or did not even try to resolve this issue.

Do you think you've covered yourself against late fees by using automatic draft to pay your monthly Bank of America credit card bill? Not a chance.. A recent revelation that I will share with you. I've alway used autodraft to pay scheduled monthly payments of $500 on the 10th of each month almost a week ahead of my due date. Got my August 2007 Bank of America statement with a billing line that said LATE FEE FOR PAYMENT DUE 08/09--$29 Hmmm.
I immediately called Bank of America --I explained to the Rep that there was an obvious error as I have used automatic draft to pay them for years. In a matter of fact manner she quickly said it was because the due date had moved forward some 5 or 6 days. ...as if it were routine to shift the due dates forward. After some colorful conversation she agreed to take the $29 off as if that were all it would take to make me happy!
I asked to speak to a supervisor as I was curious as to what their explanation was for shifting due dates forward. I carefully listened but still cannot tell you that I knew why. He kindly tells me that if I wanted to avoid future late fees I now would be required to log on to their web site, get into my online account and change my draft date up to coincide with Bank of Americas new unannounced due dates. It was very kind of him to offer advice on the specific actions that I now would have to take.... At that moment I told him to close my account and send me a check for my credit balance on my credit card... And can you believe that he actually wanted to know why I wanted to cancel my card?
The disturbing thought is how many thousands/millions of Bank of America cardholders using autodraft for payments will be duped.

I missed a payment in July and my interest rate went from 10.9% to 33% plus an outrageous (close to $50) late fee. I understand that this is legal because it is in the fine print, but I find it horrendously unethical. I called the bank to complain and was resoundly scolded for being late on a payment (despite having been a customer for 12 years). I was also told that B of A was doing me a favor by only raising the rate to 33% rather than the Default rate (whatever that is).
I feel that this behavior is part of an increasing trend whereby credit card companies are gouging customers with petty fees and costs that are disproportional to the offenses. Is there some legislation that could be passed to regulate this industry and prohibit unethical practices such as these?
Fortunately, I was able to pay off my entire balance and will no longer use this card. However, I can see that if I did not have the resources to pay it off, I would have been stuck with an enormous APR and huge difficulty in paying it off.

I opened a Fleet Credit card in 02/98. I used and paid for the card until 2003. All my statements and communications were from Fleet. I was faced with the difficult task of filing a personal bankruptcy in 2003. Since all documents came from Fleet Bank, therefore my correspondence from my bankruptcy attorney, court and all documents, were sent to Fleet. Lo and behold, Fleet was merged/bought out by Bank of America. BOA reported to all credit bureaus that I had an account, with all monetary values matching, which was listed for Fleet, but claimed it to be charged off. I filed a dispute with the credit bureaus for fraud because I never received any communication of the merger/buy-out between Fleet and Bank of America.
I never received correspondence from Bank of America or Fleet at all, regarding a change of status or a change in ownership of the account. Upon talking to the fraud department of Bank of America - they were giving all the facts such as my last payment date, address and monetary values to the day and penny, as my Fleet card. Good for me I had retained all my Fleet statements from 2003 that matched the amounts, dates and address as shown on the computer system at Bank of America. All communication from Fleet, showed no indication in the change of the account going to Bank of America. I had been denied a mortgage due to the issue. I am now waiting for Bank of America to pull the original credit application so that I can prove that I never had a Bank of America card.
Then, I will need to send my bankruptcy petition, discharge, credit app, all to Bank of America because Fleet did not properly communicate with me. When I call Fleet, I am automatically told that the number is a non-working number for Bank of America. To me this is a violation of the Fair Credit Reporting Act. All the data for Bank of America on my report should be listed under Fleet, because the origin of the debt and all communications and transactions were made through Fleet.

I am writing to you today in an attempt to disclose what I consider to be the latest questionable maneuver by credit card providers to scam unsuspecting credit card consumers with questionable and unreasonable late fees.
I have been a card holder with MBNA Quantum for approximately 10 years, with an excellent? credit rating and a high limit Mastercard. As you know, Bank of America acquired MBNA last year. Throughout my relationship with MBNA I had never had a late payment.
After acquiring MBNA, Bank of America immediately set about tinkering with the terms and conditions of my Mastercard agreement all of which I immediately declined in writing. However, the most disturbing change has occurred just recently when B of A started adjusting my billing cycle date(s).
My monthly bills continued to be received on or about the same time each month, but the due date? was quietly and conveniently moved closer to the date of receipt of the statement and they eliminated any grace period for posting. So unless I pay the bill immediately upon receipt, I am likely to encounter a significant late fee due to possible postal delays. During the past several months I have encountered two unreasonable late fees on my statement because my payments were conveniently posted one or two days after the due date, this after a 10 year history of payments in advance of the due date. When questioning B of A on the matter I was told by customer service in very curt terms that the reverse side of your statement clearly states that; Your Payment Due Date Will Not Fall On The Same Day Each Month and there is no grace period!? Needless to say I immediately cancelled my card account!

We called customer service and the first thing they wanted was our annual income. They said that we needed to take out a home equity loan with a lower rate. We told them we were not interested and they said that they could not change the rate on our card.
They asked us if we were having financial difficulties and became very rude. I am an MBNA cardholder since 2000. I called the company in 2006 to activate a new card with a high limit. I enrolled in the trial period of the Credit Protection Plan they offered. A month later, intending to take advantage of MBNA's 0% APR balance transfer offer, I determined that the Credit Protection Plan would no longer be financially feasible and notified the customer service agent to cancel my enrollment. This was because pricing for MBNA's Credit Protection Plan was based on monthly balances as opposed to a flat fee. After Bank of America, with whom I have maintained a checking account since 1996 acquired MBNA cards, I simply monitored my balance and paid my card online through the BOA online interface, assuming all the while that there were no new charges as I had not used the card ever since the balance transfers.
I recently returned from an overseas trip and opened my paper statement and saw $195 in charges for the last month for Credit Protection Plan, which I knew I had cancelled months earlier and within the trial period for that product. I also noticed that over $850 of purchase charges were being carried at an APR of over 20%, even though the bulk of my balance (from the balance transfers) was still within the promotional period subject to 0% APR. I immediately called customer service. After 2 phone conversations with individuals at the BOA/MBNA's customer satisfaction department, 1 phone conversation with a plan administrator at Central Indemnity company and 1 phone conversation with an individual in BOA/MBNA's billing inquiry and dispute department, this is what I learned:
1. The customer satisfaction agents detailed several entries in my account regarding past phone calls made in reference to the Credit Protection Plan. The last one indicated "customer called to cancel plan."2. They told me I had to talk with the Credit Protection department.
3. On being transferred, I learned that the Credit Protection department was actually a different company, Central Indemnity company, and only when I had directly asked the individual, that individual denied ever having received notice of my cancellation.
4. I called BOA/MBNA again and their rep said that it was always policy that I cancel directly with the Credit Protection department.
I then called disputes at MBNA/BOA and told their rep (Holden **) that I was ready to pay my MBNA card in full, bring suit regarding the disputed charges and ultimately cancel my card (even though it has a high credit limit). I also indicated that I was willing to move my checking to another bank, even though I have been with BOA for over 10 years. They immediately caved and said that they would take care of the matter, subject to me filling out the required dispute forms. It is noteworthy that in the initial conversation where I was offered the product, no mention was ever made that the Credit Protection product was sold by another firm. Mr. ** in the disputes department said that he understood how many of MBNA's sales reps could be misleading potential customers by not disclosing this information.
I told him that this could potentially create a representative agency by which MBNA becomes responsible for conveying cancellation information. It appears to me that there may be many customers who are unaware or unable to discover the nature of this commercial fraud and to pursue it to a just and proper conclusion resulting in a refund. Although, after much work, I will be able to resolve the matter and continue my business dealings with BOA/MBNA, I would be interested in speaking with a qualified law firm about the merits and likely recovery as a lead plaintiff in a class action for such a lawsuit. Although currently residing in Arizona, I have significant ties to California where I am soon to return for a new job. I believe an action under section 17200 of the California Business and Professions Code may be warranted.

I have been putting every extra penny into paying down my BoA credit card balance. When I went to make a 2nd payment for the month I found that a total of $160 had been charge in pure interest to my credit card. When I looked at the interest rate it has gone from 12.99% to 24.99%!
BoA told me they had changed my rate because I had some delinquencies in my credit report. I freaked out thinking I was a victim of identity theft. I pulled my credit report and all my accounts were in good standing. I have never been late in a payment and I always paid close to double the minimum payment.
While talking to the bank, they offered to transfer me to one of the credit bureau agencies. Well, they transferred me to a truck repair place, thank you very much!

I have had a credit card with BoA for approximately 4 years. The Annual Percentage Rate remained at 7.89% until this month. It is now at 14.21%, nearly doubled!
I called BoA, asked why and was told that because I had only paid the minimum monthly payment they were increasing it.
In order for us to pay off this credit card we would have to make a monthly MINIMUM payment of $140.00. We would then, barring any increase in the interest rate, pay it off in 12 year 3 months.

I made the mistake of borrowing $6500.00 against my $0 balance credit card, with the special interest rate of 3.99%. I was told the only way to get the 3.99% was for the bank to credit my account on-line. On March 21, 2007, I saw the 6500.00 credit in my checking account (actually 6590.00 - 90.00 being the balance transfer fee), while my credit care account was 0. Somehow in my head, I thought the 6590.00 should be in the credit card account, so I went on-line and did a transfer of funds from checking to credit card. Shortly thereafter, I realized I should not have done that, and called the bank to cancel the transfer.
I was told by the credit card division not to worry about it, just transfer the money back after it showed. On March 23, 2007 the credit of 6590.00 showed in the credit card account, so I then transferred that credit back to my checking account. This essentially put me back in my beginning position; however, I was charged $195.00 for that transfer, as the credit card division stated it was a cash advance.

I was a victim of the BofA buy out of MBNA. I had a balance on my MBNA credit card. BofA hiked the interest on the account from 4% to 28%. MBNA had guaranteed me 4% for the life of the transfered amount as long as my account was in good standing - which it was.
So, I contacted my credit union and they sent BofA a check for $6,506.96 on 11/15/2006 to pay off the BofA (old MBNA) credit card. I called BofA and closed the credit card account. The cancelled check cleared on 11/22/2006.
BofA has yet to find the $6,506.96 and has reinstated my balance on the closed account.
I called today (4/9/2007) to complain again. BofA has been given copies of the front and back of the cancelled check. BofA can't find the money. They are holding me accountable even though BofA cashed the check.
They are holding me accountable even though BofA cashed the check. This amounts to $6,506.96. They admit they cashed the check but will NOT give me final credit for it. They have issued temporary credit. On 3/23 they reinstated the balance from a previous credit issues in early 2007.

Hello again. Bank of America called me last month (March 07) with an offer to settle my $21,000 debt for $5300. I agreed this was a very good deal and tried to get a loan. I called them and told them I've had no luck getting a loan. They lowered their offer to $4300 and told me about the way they accept payment. I was required to give them a check number, the routing number and my checking acct number and they would cut this check and I would void that check in my checkbook (I think they called it a Quick Check)
My understanding was that I could call off this deal if I failed to get the money. On Friday, March 30th I called again tell them I had failed to find a lender. I talked to Kathy and she lowered the offer again to $3225 and told me I had until 10pm EDT on Saturday 3/31 to take advatage of this offer. Finally, on Saturday night I called off the deal, I had not found a loan,
I talked to Kathy and told her the deal is off and I'm tired of having hope where there is no hope. To my knowledge, I had veto power in this matter, they did not tell me otherwise.
On Easter Sunday I made an ATM withdrawal and discovered that my balance was really low. I called my banks 24 hr phone line and got my last 10 transactions and sure enough, Bank of America had taken $542, money I told them they were not allowed to take out.
I have $80 cash to get me through this entire month (today is 4/9),
I have an outstanding check that I'll have to stop payment on ($30?) and I'll have to put off my phone and electric bills for this month. I am royally screwed!

Since MBNA was acquired by Bank of America, I have been, and continue to be, plagued with credit card problems. The latest involves a fraudulent charge of $506.00 to my account by a company called Fifth Avenue Colle on 1/11/07. I attempted to call the company but the listed tollfree number is not valid and a search for the company by name on Google produces no such company. I have advised Bank of America twice by phone and finally by mail, but the charge remains on my account. I paid last month's bill on time, as always, minus the disputed charge, as advised by the agent during one of the phone calls, but now find that my account has not been credited with the $506 charge, and an interest charge of $35.90 has been applied. The latest problem manifested itself today when I attempted to downloaded the February account to Quicken. Only the last 5 charges were downloaded plus, of course, the interest charge.

The BoA charged me more than $300 in continued overdraft fees without notification, then sent me only one notice about an overdraft problem. I have been a member with MBNA (Now Bank of America) since 1999. I had always had a 10% interest rate on my credit card as well as promotional rates for balance transfers. In September 2006, after NEVER paying a single creditor late, MBNA jacked my rate from 10% to 22% with NO WARNING. When I called the 800 number to inquire about the hike, the rep, instead of answering my question, proceeded to lecture me on credit responsibility.
I asked for a supervisor and he said he was the senior analyst on the floor. I politely ended the conversation and tried again. Another man (completely different) proceeded to tell me that they elected to raise my interest "because they can".

This started about May of 2005. My now ex husband applied for and received credit cards from three different companies in my (maiden) name, using my personal information without my permission or knowledge. I received a call from Bank of America saying that I was late on my payment for my credit card. I told them that I didn't have a credit card. They informed me that I did and that it was over the limit and the payment was late.
While the other companies agreed it was fraud, Bank of America has completely ignored my statements of fraud. I reported the fraud to them and if they did investigate, they decided that they would rather try to get payment out of me than try to catch a thief. I explained the circumstances and that I was in the middle of divorce proceedings. They ask me to send them a copy of the divorce decree after it was heard. I complied and highlighted the part in the decree that stated "credit cards were taken out fraudently in my name, using my personal information without my knowledge or permission by my husband and that he was responsible for the debt".

In 1994, I had to file bankruptcy due to the death of my husband. I waited the ten years but while I was waiting for the time before bankruptcy was removed, I rebuilt my credit. My husband and I bought a house and my credit was okay enough with me rebuilding that we could get the loan. 1999 was when we bought the house and in 2004 during the low interest rates, we wanted to refinance. But when the loan officer ran my credit up he was shocked by the fact the there was a Fleet Credit Card stating I was 22 times late on the card. I got all my credit reports from the big 3 and filled out papers, trying to find what Fleet is. I know I never had business with Fleet.
I pulled out my bankruptcy papers and checked all of the account numbers and sure enough the account number was a Colonial National Bank number and it was included on the bankruptcy papers. I sent it all to the 3 big companies, explaining that beside the fact I never did business with Fleet, it has already been 10 years since the bankruptcy that should have been removed anyway. Equifax is the only one that refused to remove it. All they did was put "included in bankruptcy" but the 22 late payments were still there. I called Equifax and asked why they wouldn't remove it. The girl I talked to was really snotty; so I asked to speak to her boss, and she told me that her supervisor would call me later that day; no phone call.
I had to be removed from our mortgage papers and could not get the best refinancing interest rate because of Fleet and Equifax. So now, if someone calls me from the bank or I want to check on something about our house, they will not even talk to me because my husband is the only one on the mortgage. I was so livid about this and this hurt me as much as filing bankruptcy did. There were other accounts on there but they were removed immediately from the credit report of the 2 other credit reporting companies. I really believe if a bank is sold or whatever, there should be some way the information is given to the new company and not be able to give wrong information about a customer. Equifax prides itself on accurate info; well not this time.

Bank of America (BoA) has employed another insidious method to reach into our wallet and charge more interest. They call it trailing interest. Even if you pay your BoA card in full, you next statement will contain an interest charge - even if you made no further purchases! Their explanation: they now charge interest for each day after your accounting period ended and until your payment is received. So if you wait till near the due date to pay your BoA credit car bill you get whacked harder. With trailing interest, you may never get out of the credit card hole - even if you pay in full each month and have an exemplary credit history. You have to stop using the card and call for a 10 day closeout figure, which will also contain some trailing interest.
This is yet another prime example why the banking and credit card industry cries out for regulation. But that won't happen anytime soon with the we love big business, we can be bought, and screw the consumer do nothing Congress. That leaves us consumers two choices (beside another Boston Tea Party), vote for representatives that are consumer friendly and vote with your credit card. Politely tell BoA and others who employ this tactic to put their card where the shine doesn't shine. And make sure you tell them why. Trailing interest especially hurts (and most likely targets) those who can only afford to make the minimum payment each month and just make it by the due date. Not only do they get whacked twice, they go deeper in debt just by paying tghier bill on time! Congratulations BoA for moving to the bottom of the credit card cesspool. Amex and Capital One don't do this (yet) so that's where you should take your credit card business.

What's really upsetting is that they applied increase to existing balnce, not just new charges. I phoned and they refused to do anything.
My current balance is $12,590. A rate jump from 8.99 to 18.99% is significant on that balance.

The woman said I'd ordered it by phone. I asked for a record of the phone call, she said it was probably erased by now.
I said I wanted to file a complaint. She said if I dropped the investigation, she'd credit my account two months. If I continued (with scant hope of winning my case) I would not be reimbursed. I just took the reimbursment for two months and am out $600, plus any interest I paid on that money.

We began receiving charges for a credit protection program since 2/24/05. We called to tell them that we never ordered such a program, and their representative said they would cancel it immediately. We continued to be billed for the program and made several more calls up to the present time. They now say we owe $256.71. We wrote a letter explaining that we had not ordered the program and did not owe the money. Their reply was that we had failed to cancel the program within thirty days of the receipt of the terms and conditions of the program.
I have most recently paid off the account and informed them that we wished to cancel our account. I subtracted the $256.71 from the outstanding balance. They continue to state that we owe that amount for the program. I asked them how I could be subject to terms and conditions of a program that I did not order and was not a party to. I await their reply and consider the effect on our credit rating if they continue their stance. I do not want to defend a lawsuit or bring one for slander of reputation. I just want out.

When I called MBNA I was told the fee is 3% of the payoff. I tried, with no success, to explain I never knew about a transfer fee and the rep said I had to know because it is read to everyone at the conclusion of the loan approval. We decided that a granite countertop would finish the project off nicely, but I needed an increase in my limit to make the purchase. My credit limit was 13,500. On their website (their voice prompt system points you there for credit increase requests) I requested an increase. The website asks you for a specific final credit limit, so I entered $15,000. The website approved the request and went and made the purchase.
Two days later, I received a letter in the mail saying that my credit limit would be adjusted to $14,500. Later in the month when the statement came, they charged me $40.00 for being over my limit. I disputed it and they all but said I was a liar and that they do not hand out increases online. Further, the service rep suggested returning the merchandise since I spent so much. The other thing they said was that they will approve at the point of sale so not to embarrass the customer when trying to make a purchase. I have a Master Card credit card thru SunTrust, this account has been active since 1988. On 30 March 2006 I received my monthly credit card statement and noticed that the interest rate had almost doubled, from a 12.97% APR to the present 25.49% APR. This was not the first rate increases, the first time was when they defaulted on a 6 month introductory rate by one month, at the time I made the payment regardless of the error, thinking that it would be more trouble to resolve, than to just pay it, the later APR increases seemed to be due to honest market fluctuations, until now.
Thinking that this was an egregious mistake, I contacted Bankcard Services at the toll free number 1-800-223-7046, I first talked to a account representative (Jeannette), and I informed her of the problem, she pulled up my account information on her monitor and promptly informed me without further queries that she would transfer me to the Account VP. Gloria, an account VP answered the phone and asked for my account information, and asked if she could be of any assistance. I informed her that my credit card APR had doubled and wondered why this would happen since no payments had been late or missed since 1988.
She asked me if I had made a late payment or missed any payments to any other companies, I quickly responded by saying NO. She then proceeded to ask me what my annual income was, and how much I was paying in rent or house payment. I informed her of my financial condition at the present. She said that my total debt to income ratio was too high, and said that I did not make enough money, and that the bank would incur a bigger risk that I could not make the payments.
Therefore they would raise my payments from the previous month $246.00 at an APR of 12.97% equaling to a $124.02 monthly finance charge to this month’s statement of $389.00 at a 25.49% APR bringing up the finance charge up to $268.23. It’s obvious to me that this is a well crafted profit scheme; since the finance charges increased by $120.40 per month by only raised the principal payment by $1.21.
My reward for making all my payments on time and in full has come to this; I think this is an extremely unjust business practice and should be made illegal. Now that the corporations have literally put the screws to me, all I have to do now is wait a very short while for my myopic government to slam the hammer on the head by increasing the principal payments. Thank you Congress! My payments will probably increase to $700 to $800 a month on this credit card alone. Talk about adding insult to injury! Let’s not forget that this honest, well intending conglomerate was a major leader in the Bankruptcy Reform laws and a major contributor to the Bush campaign. Money does talk! And citizens walk.

I was the co-signer of MBNA credit card and I maxxed it out at $18,600. The interest was low, something like 8%. I was making the minimum monthly payments and MBNA decided to pull a credit report on the card owner and found one little Blemish on his Credit Report for a Time Share he had quit paying on and was in dispute over at the time. So they jacked the interest up to like 26.99% so that made the payments go from $240 to over $600 per month so I did not have the budget to pay those kind of payments.
I called once and MBNA lowered the interest but for only 3 months and then jacked it back up. I called them once again to have it lowered and they would not work with me. I just could not pay for it so I just let the bill go into default. Now they are trying to sue the card owner (my roommate)which did none of the charging, I did. Then after that, finally, the credit protection was cancelled early in November after I called in October, but not before charging $14.31 for it again, causing the account to be over the limit and MBNA to charge $49 fee once more.
MBNA refuses to waive the second $49 fee. I'll be $49 poorer because MBNA by charging $14 after cancelling, made my account to be over the limit for $8 a 2nd time. It takes an average of 20 minutes to have someone at MBNA to answer a call. They are set up to charge abusive fees. Today, they said that they will reimburse the $14 charged in October but that it will take one or 2 billing cycles to show. I have to pay $49 fee unduly charged for their slowness and their unauthorized charge of an already cancelled protection plan. Is there a way to have them reimburse this abusive fee, or must I join others in a small claim suit?

I have had a card with B of A for years. I have also had my checking and mortgage with them (until recently). This month's bill shows my card at an int rate over 20%. This was suprising as I have excellent credit and have made no major purchases since buying my current home about a year ago. The int rate on my previous bill was 12%. They explained that the increase was due to the purchase of the new home. This seems odd as the purchase was some time ago and the mortgage balance is about the same as the home I sold.
My guess as to the real reason for this increase in rates is that It is now December and they are trying to fleece customers making lots of Christmas purchases. Merry Christmas you bunch of Scrooges!

My husband has a Bank of America Visa card which has been "over the limit" every month this year. So one month, I sent in everything that was over the limit, plus the interest rate and finance charges from the month before and about $100 extra dollars. It was almost a $500 payment and the following month, they raised his interest rate and moved his billing date so that he was once again $16 over the limit.
I attempted to pay about $2,300 from my other credit card and they refused to accept it as payment. I sent in a courtesy check from my credit card which they also refused. He has paid over $300 a month for a year and his balance has not dropped one cent. Bank of America is unethical and this should be illegal.

In Dec. 2004 I received a pre approved credit card offer from Bank of America which I accepted. For the next 10 months I used the card and always paid my bill on time; usually much more than the minimum payment due. Then, in Sept. 2005, out of the clear blue, when I went to use my card, it was cancelled, online bill pay was stopped, online account access was denied.
When I called Bank of America my account was transferred to the bankruptcy dept. and I was transferred to voice mail. I pulled my credit to find that Bank of America was listing my account as a Chapter 7 bankruptcy. I have not filed bankruptcy and I have a good job and very good credit. They are indicating that all my payments were on time but that the account is Chapter 7 bankruptcy.
This is a very adverse mark on my credit plus it is not at all true. And, to top it off, Bank of America never even notified me about all of this. I can never reach a person to speak with; always just voice mail. When I contact them by email I receive a brief reply which states thank you for contacting Bank of America and that is all; no response whatsoever regarding my situation. I have contacted the major credit bureaus to clear this off of my reports.

Since then, I have been contacting Fleet Bank of New York to remove this repossession from my credit report. I have contacted this company for more than 2 years. First of all, I was only a co-signer and the bank only dealt with my son. My son and his wife went into bankruptcy and had his debts dealt with by the court. Also, Fleet Bank never contacted me about this matter nor requested payment. Consequence: my credit report prevents me to receive any loans.

I was 2 days late on a Bank of America credit card payment because I was in the hospital for 2 weeks with congestive heart failure. The bank charged me a $39 late fee. I called them and they said they would remove the late fee. I made my next payment when it was due, then received a late payment notice because I didn't pay the first $39 fee that they said they would remove; then they assessed another $39 fee on top of that. I called and they said they would remove that fee as well. I then made the next payment on time and received another late payment notice because I did not pay the two $39 fees they said they would remove.
Insult to injury, they also escalated the interest rate on the card and put that amount of $25 on my bill as well. They then said they would remove that. Now they say they have removed all the fees but they still want me to pay the amount including the fees and that will show up as a credit on my next statement. So they took off the fees but I still have to pay them to bring the account current.
Meanwhile, their computer calls my house 10 times a day. I complained to the police who said that was a civil matter. I complained to Bell South who said that was not harassment and to file a complaint with the FTC. Throughout all this, I've had supervisors at Bank of America tell me that I only need to make the minimum payment all along, and I've asked for a manager to call back and I was promised a return call within 24-48 hours which never happened. I even call my local branch manager and she called back and said if I had made the payment on time this would have never happened and that late was late, 1 day or two months.
Nice person she is. I've had it with these corporate thugs who view their jobs like its some kind of religion and the bank is always right. BOA is the Taliban! May they all be sucked up by a bigger fish and may they all find themselves on the street without a job or a home!

In June of 2001, I was contacted by Fleet Bank to tell me that I owed them money. I have never had the credit card they said I had, and after a couple of months battling with them, I discovered that Fleet bought a block of accounts from MBNA. An old, closed account of mine was among them. In February of 2001, they sent a "We want you back" letter to an address I had not lived at in 6 years. The current occupants of that address accepted the offer on my behalf and spent the money on my behalf as well.
It took my husband and me 6 months of dealing with Fleet to get them to recognize that it was not, in fact, my account. However, in the duration, we were receiving bills at my house for the card balance. Once they agreed it was a fraudulent account, they reversed the principal and interest charges on the account but informed me that I was responsible for the late fee and overlimit fees incurred. We battled with them for another 5 months to have that also removed.
I immediately placed a Fraud Alert on all 3 of my credit reports and have been happy ever since until July of 2005 when I ran my Equifax report and there was the Fleet account with the full balance, interest, fees and all. I contacted Equifax who informed me that the "date opened" on the "new" account was different than the one on the account that had been removed in 2001. Evidently, Fleet/Bank of America changed the "date opened" (which was listed in both instances at 1996 when it was actually 2/2001) and re-filed the account as seriously delinquent. I have a very good credit score, so aside from a lower score, I don't believe there has been lasting damage to me. However, I am concerned that this account will continue to crop up incessantly and would like to take steps to avoid that.

I was told I received a letter, which I did not, even though the person on the other end said that she had the letter right in front of her. My bank records show your company was paid on March 9, 2005 in the amount of $50. That amount was taken out of my account on that day for your payment. In 2003, I had maxed out a 9.9% fixed-rate Fleet credit card to $7500. My payments going out were dangerously close to my salary coming in, so I elected to destroy the card and start paying it off at more-than-minimum payments and I informed them of that. After making on-time payments for about a year online, I went to make a payment and they wouldn't take it online but gave me a number to call.
I called, and they informed me they had sold my account to FNBOmaha and gave me a number to call them. I called and made my first payment to FNBO on the phone, since I hadn't received a bill or anything telling me of the transferring of my debt from either party. The next month I didn't get a bill either, so I called to make a payment and they said I was late already. I told them my payment day wasn't until the 22nd, and they said my payment day wasn't the same anymore. I asked when it was and they said the due date would vary from month to month. I told them I wasn't receiving a bill, and they said I was.
About 6 months later, I wasn't paying close attention and discovered that about 5 months previously, they had doubled my interest rate to 19.99%. At the time, I was living off almost nothing with all my pay going out to bills so I was "broke" and called them and told them I couldn't pay everyone so I would take their share of my pay and distribute it among my debtors who were treating me with more respect. In a few days, they called and apologized and put the interest rate back to 19.99% with the agreement that it would remain that way as long as I made my payments on time. Though I lost the extra interest I had paid, I was relieved to get it back into a manageable state.
So now (a couple of years later), after always making my payments on time, I notice that they have raised my interest rate to 10.28% in Nov. and then to 10.42% in Dec. and then to 16.61% in Jan. When I called and asked why, they said they raised my interest rate because a credit check revealed I had been late on payments to another creditor! Is this legal? Someone please help us ignorant credit consumers who sometimes fail to read the fine print and don't understand it when we do.

The supervisor told me she would listen to the recorded conversations and see what was said but in the meantime, she put me into a low rate interest account. She said it would be 3-4 weeks before I would hear from her. It has been 5-6 months and I have not heard (lie #1).
Last month I never received my statement. I called and accessed your mailing address and amount due. I was assured since I did not receive a statement, my account would be noted and it would not disrupt my low APR. I received this month's statement and I am now being charged a horrific interest. I called yet again and was told that there was no note about my calling and not receiving a statement and that was the way it was going to be (lie #2). There was no attempt to resolve this issue. I am sending a payment in full to close this account. I called and spoke to a rep named Infinity this evening and she was of no help. She did state, "Oh, I see you have called with issues several times in the past month" making it sound like I don't have a right to call on these issues. She offered no assistance.

On Dec. 28th, I received at least 10 phone calls in 2 hours from a law office (collector) in Massachusetts. After calls to my cell phone, harassing my 13-year old son at home until he gave the caller my wife's work and cell number, the caller reached my wife at work telling her if we didn't pay the $7,900 balance we owed Fleet by 4pm that day, they would file suit against us, put a lien on our home and attach her paycheck.
I called the firm back and was told the same information. Even though I was in a program, without warning, notice or letter, Fleet charged off my account on Nov. 11th and sold the account to an investment firm, now being represented by this law office. I was told the same that I had until 4pm that day or I would be sued. I contacted Fleet and found that my account was charged off on 11/11/04 even though Fleet received the July, Aug, Sept., and Oct. payments as agreed in the re-age program. Then after the charge off date of 11/11, Fleet took the Nov. and Dec. payments also. My bank verified all six payments were paid to Fleet. I asked why this happened and was told a payment was returned in October.
I explained my bank's position that all six payments were made and cleared and gave the rep the exact dates the checks cleared. I asked why I received no letter cancelling the re-age program, advising me the account was charged off, or even a warning the account would be charged off. Why was I not notified the account was sold and/or transferred? Why was I not offered a settlement figure? Why were two payments taken out of my checking account after the charge off date? I complied with the program and made all six payments. Fleet should have re-aged my account, removed any fees accumulated in the six months and left me with no past due balance and a lower interest rate! I did that out of frustration that it continued to remain open. I signed on with Fleet credit card services a number of years ago. My limit was low and up-to-date for years! October of 2002, the job I had been employed with for almost five years decided to cut my salary, not a little bit, but $436 per month! I had just purchased a car a short time before October, the first car I bought for over ten years and felt that my job was a stable one; at least that was what I had been led to believe. I began looking for another job, but none was to be found in the area I lived in so I took another 40 hours per week job in order to help offset the loss of money. I was 55 years old at the time and working 80 hours per week was adding up fast. I searched for one job and only found it in a bordering state. So I made plans to relocate in order to work one job, not two.
I explained to Fleet, time and time again, the circumstances of what had happened. I begged them to work with me. I fell late, not by much but a few days, but they took advantage of the incidents and kept charging late fees until my limit increased beyond the limit allowed. Then they charge me late fees and over the limit fees, even though we spoke on the phone many times. They also deducted the sometimes late and sometimes over the limit fees, but each month I would receive my bill and it would have charges over and above in these same two area in order to keep my balance "way up there." Each month I called asking what we could do. The only suggestion they made was for me to pay more. I explained that I was paying more for them than most of my bills and it was difficult for a single (widowed) female as it was without having to work like I was and deal with the other problems at the time.
I also had to have two major surgeries prior to my job reduction and fight with other health issues. I explained time and again that indeed I had made the debt and was more than willing to pay it, but needed someone to work with me and change my due date, bend a little with my calling to inform them I would be late, etc. All I got were sarcastic comments (not from all agents, but most) and when I asked where I could write to have the facts reviewed or where could I get in touch with an executive or consumer department, I was told "I will be the only person that can help you; no one else is going to be able to do anymore for you than I will." I have spent hours on the phone pleading for someone to just listen to my facts, allow me to pay the bill but work with me, not against me. I have been unable to get anywhere!
Several months ago, when I called, I got a young man by the name of Mark. He was very sarcastic, critical and showed no empathy whatsoever. He was so nasty on the phone that I requested the conversation be recorded before we continued any further. His whole attitude changed, some better. After we again went through the conversation, I told him that since I had requested the conversation be recorded, his whole attitude had changed. I also informed him that I was 57 years old and did not treat him disrespectfully and did not feel I should be spoken to in such a manner. He never once apologized nor made any effort to change until I asked for the recorded conversation. At the conclusion of that conversation, I made the statement that I was most dissatisfied with Fleet and intended to pay this account off with or without their help. It would take me time but I would get it done.
It is my practice to pay my debts, not slough them off or ignore them. My credit was impeccable until I lost my husband and fell into several unfortunate circumstances afterward. This incident has not helped my health nor my credit. About 2 1/2 weeks after this conversation, I received a letter from Fleet stating they were closing my account. I then called to register a complain because in the former conversation, I made the statement that as soon as I could be current for 6 months as I was told I would have to be and as soon as I could get them to lower my interest rate they had run up to 25.54%, that I would close my account and pay it off!. Soon after that came the letter. I then called to let them know I was dissatisfied and not at all pleased with the fact that they had closed my account when I had already volunteered to do so, once my interest rate was lowered.
I feel and told them so that the only reason they chose to close the account at that time was to "lock" me into the higher interest rate until I paid the account. Each month I am charged more interest than the amount of payment I make. At the rate things are going, I will probably not live long enough to pay this account out. I hope I do and certainly plan to. I have asked several times for Fleet to reopen the account so that I can lower the interest rate and get no cooperation whatsoever. The interest rate cannot be lowered unless it is an active account is what they told me. Please help and advise.

When I complained to the company, they said that it was because of my employment status (isn't this discriminatory?) and because of another credit card bill with another company (which I also always pay on time).
I then responded with, "What has this got to do with my ability to pay? I do not have a negative report on my credit history (I have an up-to-date copy) and have even received several offers from companies including Fleet saying that I was a good customer with good credit?!" Go figure that one. They responded with giving me 13.99% Whoopee! So here I am penalized for being an on-time paying customer! Next I received 2 bills in the same month, Aug. 2 and Aug. 31, 2004. The due dates keep changing and seem to be creeping up every month. I had to pay a $15 check fee just to make sure the payment for Aug. 31 got there on time. When I called to complain about my due date and the fee, the Fleet representative responded with this is how our billing cycle runs. She said she would "waive" the $15 check fee if I called next month after seeing it on the bill.
So I called next month in September. I was unable to reach Ms. Miles (ext **) and was told they don't waive checking fees. I responded with I was told by Ms. Miles that she would waive the fee and the representative told me that they have so many reps that there would be no way to locate her. What kind of company does business like this with good paying customers? This is a devious and deceitful practice and Fleet should have to answer for their business dealings. As of today (I believe because of my complaining), they have lowered my interest rate to 10.9%. However, I was very pleased with the original 7.9% and this was why I chose Fleet Credit Card company. But as soon as I finish paying, I'm no longer a customer and I have already informed friends and family members to stay away from Fleet.

I cancelled my account with Fleet in May, and have been paying since. In August, I contacted Fleet and told them that I would like to pay my balance off and terminate my business with them. I was told an amount, which was the same as the amount on the bill. I promptly sent them a check for the amount and wrote "paid in full" on it. It was cashed by Fleet. Today, I received a bill from Fleet for $30.37 - $9.87 in "residual finance charges", and $21.50 in late fees.
I called and was told that they would waive all but $11.38, if I would send them a check right away. I refused, saying that I had already paid them hundreds of dollars in questionable fees. I was threatened with the "credit bureau". I have had similar experiences with the other credit cards I paid off (Capital One). They won't let go, and want to keep charging me even after I have paid off every cent that I owe them.

I had an identity theft incident on my Fleet Card. Somehow my address got changed and charged over $2000+. When I found out, I called Fleet. The woman on the phone was actually very helpful (I thought so anyway). She said they would investigate and get the charges taken off and for me not to do anything until I hear from them. Well, I didn't hear from them for a while and I tried to call. I was given a special number for these cases. I had to leave a message and no one ever called me back. This was in September. So I figured I would wait like they told me to. I eventually forgot all about it. I did have like a $400 bill that was legitimate.
I was contacted by a collections agency a week or so ago. Apparently instead of contacting me, Fleet has sent my account to Collections. The collections agency had my address listed as the one that had been changed by the criminal that stole my account. This, I am sure, is why I haven't heard anything. I called Fleet and was given another number to call where I have to leave a message. I have called twice and received no call back. Now a week after finding out about all this, I have over $700 owed to a collections agency and they are threatening to file a lawsuit. Plus I can't get in touch with anyone at Fleet. I have contacted the BBB, FTC, and some other places that were on this site. My credit was excellent. Now it's **. I have decided to just get a lawyer to handle this. Anyone who does any kind of business with Fleet would have to be an idiot after reading this site.

I made an electronic payment of $2,000 to Fleet (as I do every month) and in July, something went wrong. There was an error in the processing, so Fleet charged me $64 ($29 'returned check' + $35 'late fee') plus interest on the non-payment. I called them and said I had plenty of money in the bank when the transaction should have occurred, and they told me in order to get the fees reversed, I would have to do two things: show them my bank statement proving I had enough money, and go to my bank and have them write a letter stating I had enough money. I did what they requested and faxed them a letter my bank drafted for me.
The first problem is they didn't make it clear that I had to initiate the payment again. I thought they would try again simply from the fact that it was an electronic error and I had plenty of money in the bank the entire time. I called them again, and asked why they didn't take out the money. They said we don't do that, you have to do it again. So I did a check by phone and confirmed with the woman there would be no fee for the check by phone. At this time, I noticed after sending the fax (previous mentioned) they did not reverse the entire $64, but just the $35. The current rep told me she would reverse both the late fees of $35 and the accrued interest on the $2,000 that should have been properly deducted from the account the prior month.
At the time we were discussing this, we were on the edge of the following payment due date, and they dinged me for another late fee! I called again after some time passed (a week or so) to complain that the previous woman didn't do what she said she would do. As usual, they were ignorant even when I told them the woman's name. I was asked for her extension, which I didn't have. It turns out she (the previous woman) processed the check by phone for $2,000, but charged me a $15 fee (she said she would waive it)! She also didn't fix the false interest. So when I was on the phone with the current woman, she said she can't reverse the interest. I'm pissed, and don't know what to do.
Consequences: I wasted several hours driving to my bank, waiting to talk to them to write me a letter; the expense of faxing documents to Fleet. I wasted hours on the phone during several conversations with Fleet. It cost me hundreds of dollars in interest and fees that don't seem to be removed from the account when Fleet reps tell me they will be removed and the general frustration and aggravation in dealing with this problem.

I originally signed on with Fleet about 1.5 year ago with an introductory offer. Once my offer ran out, my rate went to a fixed 7.99% APR. This month, I noticed my rate had jumped to 14.5% APR. I never made any late payments, always paid more than the minimum, and have a good credit rating. When I contacted Fleet to ask about the increase, they stated that the reason for the increase was that they were not making enough money on the account and that I was not using my card to its full potential. When I asked what that meant, the manager said that I had not made any balance transfers recently.
I then explained to her that I did use the card and I had a balance around $7,000. I charged $450 to the card the month before. I can only assume they wanted me to max out the card. They would not offer me any other rates and had the attitude that this increase of rate was my fault. I was informed that they had included the new terms in the previous month's bill. This could have been possible with all the crap they send with the bill that I normally ignore. Is this legal? If there was a reason for the increase (i.e. bad credit), I could understand it. They are increasing what they are charging because my $40/month in interest isn't enough for them anymore. Consequences: I had to apply for new card to transfer balance to. I cannot pay this off right away, and I refuse to stay and pay a fee to a company that slams its customers.

On 3-31-04, I received a credit card from Providian and requested to make the transfer of four other credit card accounts over to the new Providian card. This transfer request was made via the internet. The request was to transfer the amounts from three Capital One accounts and one FNANB visa. On 4-3-04, I received a confirmation letter dated 3-31-04 from Providian acknowledging my request to transfer 4 credit card balances. According to the letter, the balance transfers were to be processed on 4-18-04. This confirmation letter was written by Ben **.
On or about 4-15-04, I received new credit cards from Fleet Visa and a letter advising me that they had bought out FNANB’s accounts. Also included were some counter checks from Providian to transfer funds with if I desired. On 4-23-04, I received a letter from **, Vice President of Providian, dated 4-20-04, acknowledging the fact that all requested account transfers had been made with the exception of FNANB. On 4-23-04, I called Providian to see what the problem was with the FNANB account and was advised that the account number was invalid and that the payment had been cancelled and that the account would not be transferred. I did not record who I talked to that day.
On 4-23-04, I called Fleet Visa to get an accurate balance on my account and once I put in the information, was advised by a recording that the account number was invalid. After trying several times, I decided that the only way to get the information I needed was to activate my card. I then activated the card and found that the balance was $2,739.00. On 4-23-04, I mailed a Providian (acct: **) check which I had received on an earlier date, for $2,739.00 to Fleet Visa in order to pay off that account. On 5-10-04, I went to Providianservices.com and found out that Providian had in fact paid Fleet Visa an amount of $2,770.00 on 4-29-04, even after I was told they would not make the transfer. According to the Fleet Visa billing statement, on 4-27-04, a payment of $2,770.00 and my payment of $2,739.00 were received.
On 5-10-04, according to the June statement from Fleet, I was charged a $25.00 annual fee even though the Fleet card has never been used and even though I have an outstanding credit of $2,745.00. On 5-10-04, I called Fleet Visa and talked to someone there who told that in order to rectify the problem, I would have to request a refund in writing. I was given a fax number. I typed up a letter and faxed it to Fleet as advised. On 5-24-04, I called Providian Visa and spoke with Omar. I asked him to put a note on his computer that the Fleet Visa account was overpaid which put me in overbalance status, and that I was trying to take care of the problem with Fleet.
On 5-24-04, I called Fleet Visa and spoke to Steven about the problem of double payment on my account. He stated that the money could not be sent to Providian but Fleet would have to cut and mail me a check and I could then pay Providian if I still wanted to. I mentioned that I had faxed a request to Fleet on the 10th and he said he saw a copy of it and that it takes 30 days to process. On 6-15-04 11:40, I called Fleet and talked to a supervisor named Shirley. After explaining the problem to her, she stated that they had my letter of 5-10-04 and that it would be 30 days before the check could be cut. I reminded her that on the 24th, the 30 days would be up and they have yet to write the check. She assured me that the check would be mailed to me at the last of June.
On 7-12-04 1100, it is now 12 days past the end of June and no check from Fleet Visa has arrived. I talked to Mr. **, Supervisor at Fleet Visa. After explaining the problem, he told me they had tried repeatedly to get information from Providian and that Providian would not respond to their requests. He advised me to contact Providian and have them fax the information to them that would confirm a double payment to the Fleet account. He stated that they had to ensure that the credit was not posted in error. He gave me the fax number as 706-644-0670 and his extension as **.
On 7-12-04 1110, I called Providian and talked to the transfers department. The lady there stated that she could see the double payment on her computer screen but would have to request copies of the payments and would mail the copies to me. She further stated that I should have the information in 7 to 10 working days. On 7-21-04, it has now been 7 working days and no information from Providian has come in the mail. 7-26 will be 10 working days. It will be interesting to see what happens. On 7-21-04, I called the FTC and filed a complaint against Fleet Bank. The person who took the complaint was Beverly and the Reference # **. As of this date, I have paid two transfer fees of $50 each to Providian, one of which should not have been made to begin with. I have also paid a total of $70 in over limit fees to Providian. This total comes to $120.00 in excess unnecessary fees so far.
To date, nothing has been resolved. Fleet continues to have my $2,739.00 in their account collecting interest, while I continue to pay $35.00 a month to Providian in over limit fees. I am a business owner and cannot afford to have that much money hanging in limbo. I have come to the conclusion that Fleet is about as worthless a bank as I have ever seen, not to mention that they are a bunch of liars and cheats. The public would be well advised not to do business with Fleet or the company that owns them, Bank of America.

I called them and they sent the new card again to the wrong address! I told them to cancel the card and to please send me a bill. I want to keep good credit. I'm still waiting for my bill. After a few hours of phone calls, I found out what had happened. I cancelled the $10 charged card. I asked to be sent the $130 credit. By the time I got it back, I was low on money. I sent the other card $100. By the end of the month, I usually run out of money. The $100 didn't go through by just a few dollars. I got charged $20 from my bank and $29 from Fleet. Then they ran the check again. I got the same extra charges making the total $98 for being a few dollars short because my payment was made so late in the month. I only get paid once a month - SSI - $780/mo. I live in low cost housing. I always pay my bills at the first of the month and don't write any checks for a while so they will all clear. My complaint is the so-called "credit protection fee" that I've been paying on and off during my payback to MBNA. Now the whole thing with this credit protection fee is that it is a plan that when you are ill or out of work, MBNA will freeze your account for up to 24 months to allow you to get on track. That's what I need at the moment due to being laid off.
On 05/12/04, I received a call from an MBNA rep explaining that I have that program protection and that I should call them at a 1-800 number that was given to me. About 5 minutes later, I called the number and was told that I couldn't receive the credit protection program because it was just recently activated on 05/07/04. So, I called back MBNA and explained to them that I was told that I can't receive the credit protection that I paid for. That's when I got the talk of children. Well, it's them (Credit Protection Plan) you have to speak to; they are a different company, and they are only a partner.
I called CPP back to explain that I've paid for this program, which I never asked for, and that now that I need it in my worst time, I can't get it! The sugar-induced female on the other side of the line explained to me the reason that I couldn't receive the program. It is that as soon as your account goes delinquent, you will have to reactivate it and start all over with payments to the program! So all that money I paid them is basically free money out there. More children talk started. Well, it's not our fault that I would have to speak to MBNA about the matter at hand.
So for two whole days, I was speaking to a bunch of children who were handling my personal information and wasn't getting any help behind it. The main fact here is that I never asked for a credit protection plan. I never saw the terms of the agreement, because everything was done over the phone. MBNA, there's one thing you have to understand:
1) You have to get understanding people who have been through ups and downs in life to work there, not these bunch of disrespectful reps who call people to disrespect them or their families.2) When someone opens any type of account you should send them the paperwork first, so that they may read all the hidden ** that a rep wouldn't read over the phone. Then maybe, you won't get as many complaints you are receiving now.
3) After I finish paying you off, you and your partner companies can erase all my info from your files!

I have an MBNA credit card because it is connected with LL Bean Clothing company. Its interest rate is high, but I can pay it off monthly and I get free shipping plus LL Bean $$. When they sent me information about a line of credit for 6.99%, I called to find out more about it. They take all your information, check your credit report and then, of course, come back to tell you yours will 9.99% or something like that. I already have a very good credit card for that amount and a Dell computers account for 6.99%, so I told them forget it, I didn't want it. They tried to change my mind and I explained why I didn't want it and then hung up.
Two weeks later I get a packet in the mail with checks telling me I now have a $10,000 (twice what I said I needed before I said no deal) line of credit with them. I called and told them to cancel it and what state agency could I complain to. After being on the phone 20 minutes and never getting an answer to that, I hung up. I got a fax stating that the account was canceled but that it would take 30 to 60 days for my credit bureau information to be changed and that I would probably get more blank checks in the mail for 30 to 60 days.
I have also noticed with my MBNA credit card that if I send my payment very early (two weeks), it still takes until right before the due date for the check to go through--thereby adding extra interest. Is there a regulatory agency I can complain to that could take action against MBNA?

My MasterCard and Visa accounts with MBNA have been in dispute since September 2003 due to MBNA reneging on an agreement to reduce my interest rate to 1%. Under the agreement, I made payments for 3 consecutive months at a pre-set level (MBNA obviously documented the agreement, as their representative had the payment amounts for each account in front of them when they called to confirm the payments in June, July, and August 2003). At the end of the 90 days, I was told I had to arrange for automatic debits from my checking account at a higher level than had been agreed upon in order to reduce the interest rate to 1%...and the rate would only be reduced for 12 months.
I told MBNA that I had lived up to the terms of our agreement, and that they were breaking the agreement. I refused to make additional payments, as the interest rate seemed to constantly fluctuate on the accounts--both of which had been inactive for at least 4 years. MBNA now appears to have charged off the balance, and sold the accounts to two different agencies. One agency, out of Buffalo, has sent me written notification of assignment via regular mail. The other agency, out of Houston, claims to have sent written notification (no notice has been received as of 4/21/04).
MBNA cited a total balance of approximately $15,000; the agency out of Buffalo has cited a balance of $10,000. The agency out of Houston has cited a balance of $8.000. Neither agency claims awareness, or concern, that the balance is in dispute, nor could either agency confirm what is the true balance owing. In addition, I have filed one complaint with the Federal Trade Commission regarding MBNA, and two complaints regarding the agency out of Buffalo.

I bought a house in July 2003 and needed some money for the closing costs. Well sitting in my file cabinet were some courtesy checks that MBNA had sent me. 4.9% interest until August 2005 it said. I used the check and got $3000.00. Well I moved into my house and in September I received my statement from MBNA stating that my interest rate was 12.99%.
Rather upset I called the customer service number to be met by a very rude lady who said that she couldn't help me with my problem. She informed me that the rate on the checks were only good until August 2004. Thinking that I had read it wrong I gave in and apologized for bothering her, but asked her if there was anyway my interest rate could be lowered. She transferred me to some idiot that I could hardly understand. He mumbled, "Sorry, can't do anything for you. Have a nice night" and he hung up.
Well, I just let it go thinking that I will just live with my supposed error. In February of 2004 I received my monthly statement. As I always did I looked at the balance and my interest charged. As I began to swear loudly and lose all sense of where I was at I noticed that my interest rate had jumped from 12.99% to 24.98%. I called the credit card company and was met by another very rude lady. I asked her why my interest had jumped to such a high amount. She told me that it was because I only paid the minimum balance.
I asked her if she could close my account. She told me that I didn't want to do that. I told her that I indeed wanted to close my account and that they would receive all of their money the next month. I asked her how much my total payoff amount would be. It was in the area of $2,994.00. And then to my surprise I was told that I had another MBNA credit card with 7.9 percent interest that I could transfer this balance to if I wanted to. I didn't even know I had another MBNA credit card and I about went through the roof. I asked her to close both accounts. At that point she hung up on me.
I called back and spoke to another lady who surprisingly was very cordial. She informed me that both my accounts had been closed. I requested to talk to her supervisor and she let me talk to another surprisingly cordial person about why his previous employee hung up on me. He told me he would take care of the situation, which I doubt he did. In the meantime I sent MBNA the "Payoff Balance" on the card and wished them good riddance. Then in March I got another statement from MBNA saying that I owed them yet another $37.35 in interest charges on a balance of $1,975.00. I said....HUH.
I called again and was met again by another very rude lady. She explained to me that since I just paid the minimum balance in January and paid the whole balance off in February I owed interest from January ... which totally blew my mind. I told her that I was told the amount I paid was the pay-off balance and if I had sent almost $3000.00 to them what would another $37.35 hurt me. I would have definitely paid it but that isn't what I was told to pay. Well we argued for about 20 minutes before she very hatefully told me that she was tired of arguing with me and she would just waive the interest charge. I told that was good because I wasn't going to pay it anyway.
