I called Bank of America the day my husband lost his job to see if they would work with us, because I knew it was a matter of time before we would default on our loan. (We never missed a payment before this!) They told me I would have to default on my loan before they could help me and send me to the appropriate department. I defaulted and then was assigned a CSM. He told me to fill out a pack of papers to see if we could get some kind of hardship help. He told me I had been approved for a 3-month forbearance and to not pay anything for three months and we could maybe qualify for up to 12 months forbearance due to our unemployment.
Then after I could not get a hold of my CSM, I contacted who he listed as his manager on his voice mail. He looked at our account and told us everything was okay and in order. Our CSM changed and she had me send in more packets (total of four throughout this ordeal). She told me that I had been denied for HAMP and was "in review" for other options. She could not tell me why I was denied or anything, but the foreclosure process is halted while my case is "in review". My husband was unemployed for 5 1/2 months and when he finally got a job, we had to send in another packet.
I recently found out that instead of the CSM applying us for the unemployment assistance, they applied us for the HAMP and put in our monthly income as $1,700/month, instead of $0. I had started making our normal house payments again, but then was told they would not accept any more payments unless I paid the entire $10k in one lump sum to get current again. So this whole time, I thought everything was fine and they were trying every possible means to keep us in our home, but instead, they were screwing around. Now we have a sale date to worry about and about to lose our home because of faulty information and paperwork on their part.

I applied for a loan modification with Bank of America in February of 2012. It has been nothing but a nightmare dealing with BOA's loan managers. After 6 months of total frustrations, aggravation and lies, I decided to go public. I submitted the same requested documentation not once but 2 to 3 times. I would always fax the requested documentation using a local BOA branch and they still would claim they didn't receive it. On August 10, 2012, I received a call from a newly appointed loan officer who stated I needed to resubmit all documentation once again as the present documentation is outdated.
I have filed a complaint with the OCC in June of 2012 who in turn after 2 months sent a letter turning my complaint over to Consumer Financial Protection Bureau (CFPB). On June 4, 2012, I also sent the NYS Attorney General's office my complaint. Till this date, I have not heard from his office. I have also called his office numerous times to schedule a meeting with him but to no avail. Is government on all levels sleeping with Bank of America? I intend to blast my misfortunes with Bank of America on every possible website such as Facebook, YouTube, newspapers and anyone else who will listen. I wrote to Mr. David of the NY Times in hope of relief.
I believe if every dissatisfied customer of Bank of America puts out their story on Facebook, etc. to expose exactly how Bank of America and the government operates, we will prevail. Remember we are the employers of government and it's about time government does the job we pay them for.

We have been given the opportunity to apply for a re-modification loan. After going to the BOA loan advisory and after we sent all our forms in with the adviser, we are still getting the runaround. Our tax forms have been lost, our pay stubs have been lost, and so we are told. And we have been transferred to yet another loan officer where, as we have to start over again to explain our issue with our loan re-modification, it is to the point that we have to reach out for help. I do hope we are able to get the help we need.

We have been trying to modify our loan with Bank of America for over 3 years with no acceptance and no denial. Also, we have requested of the bank who owns our loan, and how can we get in touch with our lender (no response). We also wanted to know if the loan was transferred through (MERS) mortgage electronic registration service. Also, over 2 years ago, they arbitrarily changed our loan # and admitted at the time they had lost our file (loan papers?). How can we modify our loan if they do not own, have or know who owns our loan? So basically, they have been harassing us for over 3 years and causing me to go to the hospital for over a month because of stress! What can you do for us?

Same issue it seems as most people when it comes to dealing with Bank of America. I started the modification process in February and have gotten nothing but the runaround. I have borrowed money to keep payments up even. We have had to send in the paperwork several times. Always something missing according to them. I have been in contact with them every month. They even called me in July to let me know they had everything they needed. Then a week later, I got a letter telling me I no longer have my personal representative, that if I have any questions, I need to call their regular customer care. I got on the phone and after 4 representatives who could not tell me anything. I was promised that my personal representative's supervisor would be contacted over this, along with the representative's supervisor I was speaking with. I would be contacted within the next 3 or 4 days due to the holiday (July 4th).
Nothing! No call at all. I finally contacted my personal representative's supervisor myself. Of course, it was voicemail. I told him I wanted to know what was going on right away. My personal representative called me the next day. After an hour on the phone, she told me we were dropped from the program process back in May. May! She advised me to send in an update on our HOA fees, due to that changing, and said she would send it to her supervisor to get reopened and that this should not have happened. She stated she would call me back in 7 days. Two weeks later, nothing! I finally called again yesterday and couldn't even get through to her voicemail. The representative I spoke with stated that she was there just away from her desk. She instant messaged her so as soon as she came back to her desk, she would get my note to call me. Nothing! Still waiting.
I have decided at this point that I am not making any more payments. I lost my job in September and we are living on my husband's pay, which is minimum wage. We can't afford $1,200.00 a month! The same month I lost my job, his workplace was bought out. They reduced his wages by .90 per hour and cut his hours. There is no way to survive. Bank of America needs to be accountable for the way they treat people. I never would have gotten a loan from them. I did have any say in it because they bought out Countrywide. We refused to get a loan with Bank of America because we knew what a horrible company they were. Then, we got stuck with them anyway with no say so whatsoever!

In September 2011, I applied for a loan modification with Bank of America Home Loans. Since then, I have worked with several account managers who have requested that I fax them documents to proceed with my loan modification. Whenever I send out the documentation, the account manager would tell me that they did not receive the paperwork and that I would have to resubmit it. When I would resubmit the paperwork, the loan manager would tell me that they received all of the documents and that the case is currently with the underwriter and I would be hearing from them as soon as a decision was made.
However, no one would ever contact me and when I contacted them myself, I was told that the case was still with the underwriter and as soon as they reached a decision, someone would contact me. When I would finally call back, a decision was never made, I would be assigned a new account manager, and I was asked to resubmit the same documentation all over again. This has happened three to four times since September 2011. Currently, I am working with a new account manager. I feel that I am getting the same type of treatment that I have been getting with all of the other account managers that I've had.
In May 2012, he told me to fax in some documents, and when I faxed them in, he told me that all of the paperwork did not come through. However, I have a receipt from my fax machine stating that all of the paperwork did indeed go through. He then sent me a Federal Express packet asking for the same documents that I had already faxed in, which included an envelope for me to send everything back. I filled out everything, sent it back, and when I contacted him, he told me he never received the Federal Express packet. I received a fax asking me to fill out the same papers again; however he told me to wait a few days to see if he would indeed receive the documents from Federal Express.
After that, I have not been able to get in touch with him so on Saturday, August 4, 2012, I resubmitted the paperwork that they faxed to me. Now today, August 6, 2012, I received a letter in the mail stating that I have been denied the loan modification because I did not provide them with the documents that they requested. I feel that this situation is very unprofessional. I am not getting any assistance from Bank of America Home Loans, and it feels that they are pushing me towards foreclosure. I'm further behind on my mortgage now because one of my account managers told me that Bank of America would not accept any payments while going through a modification. However, I spoke with a representative today and she told me that this was not true and I should have been trying to send something in, even if I could not make the entire payment. I'm at my wits' end with these people!

I have been trying to modify my home loan since October 2011. It's now going on 10 months. I have faxed and FedEx-ed all my documentation over and over and over again, at least 6-10 each. When I call to follow up to confirm receipts of my documents, the say they were not received. Note, I fax and send originals of the same documents. They claim that they don't have them - they received some documents and not others, claimed missing information on certain documents, claimed that they are "changing roles" and working on back log, never call to let you know information is missing, they never follow through on phone call appointments and they never stick to the appointment time. You can never get a hold of them or the manager. They claim that they will call you within 24-48 hours, but never happens.
By the time they have the said documents, they will claim the other docs are "outdated" and they have you send more recent documents and the cycle starts all over again. They give you the runaround and string you along. If there is missing information, they never bother to call you and let you know. The file just sits until I call to find out the status. I have brought this up every single time to these representatives, that they are completely unprofessional, that I'm extremely concerned that I'm sending documents with my sensitive information (social security numbers, bank account numbers and other information) and they do not follow through with what they are supposed to do, which is to help their customers.
Where is all my information going? I do not trust them at all and they are stringing me along. Aneesah ** is the person handling my account and she does not follow through on returning calls, being thorough in reviewing my documents, fails to meet appointment times and fails to acknowledge that it is very suspicious that I sent my documents via fax and FedEx, but the documents are not received. Their technology is outdated and know that they are lying about everything. I even have left numerous voicemails to her manager and they too never return calls. I hate BOA and will never ever do business with them in any way. They need to be investigated. This is not normal business practice.

Modification nightmare - We were behind in November 11. I was told by BOA to start modification to get the one payment moved to the end of the loan (similar to car loans, skip pays). It's now August 12 and was sent the initial paperwork again (5th time). No one will call us back despite daily phone calls up the "tree" of numbers. I just want someone to answer!

I sent in 8-2009 a mortgage payment check amounting to $1001.34 to BOA. A notice dated 10-1-2009 claimed non-payment. For 2 1/2 years, I received Act 91 notices and had my credit rating ruined. Also, my credit cards were canceled, and my health was ruined. And I spent hundreds in letters, faxes, calls, e-mails, and driving time to prove my innocence with no results! However, when they sent me a letter indicating it was my bank's error, I marched down to my bank. Within 2 days, they found the missing check - magically - after 2 1/2 years of hell for me. The check was in a BOA clearing house in Cleveland, OH all that time. Imagine that! I spoke to BOA and told them I felt I should at least be entitled to the interest on my money and a refinance for a lower rate. And that was the end of ever hearing from them again(!) up until now, when I received a call from BOA asking for info on something that happened in 2009 that they claim to have absolutely no notes or info of in my account notes!

Like most of the others I've been reading on this site, I have experienced nothing but frustration with an attempt at a loan modification with BofA. The most recent experience started in May 2011. I called to try to pre-emptively avoid issues of falling behind payments due to pay cuts at my job and my wife's work hours being reduced (and thus less pay). I was sent the modification papers which were completed including pay stubs, two years tax info, and etc. Everything that was requested was returned by FedEx. And wait...wait...wait...finally I had to call them back and was told paperwork was incomplete. This process was "rinse and repeat" 2 more times, and now it is August 2011, we are over 5 months behind in payments with no ability to make partial payments or any help at all.
After 4th submission of paperwork, I was told they finally had everything they needed, but that some of the forms had to be re-done since they were outdated. 5th try and finally everything is a go...or so I thought. My "personal account manager" could only be reached on approximately one of every 12-15 attempts, and no matter which of the dozen or more phone numbers I have for BofA I called, as soon as I enter my account information, it is routed directly to this same person. In addition, when I finally did speak to them, she was never able to actually do anything, always requiring "more research as to why this or that has happened". And always gives the reassuring "I'm here to help you. I promise… and I will follow up with you...” **!
Fast forward to 14 months into the process, wife is now unemployed and we are 2 months into a 3-month "trial payment" which ultimately was their idea of our new permanent payment. Bottom line was that although we were struggling making our payment, their idea of "help" was to increase our payment over $250/month when clearly our situation not only had not improved, but was in fact worse than before.
Desperate... we cashed in my wife's 401k and paid off the entire past due balance of nearly $8,000. I had to literally speak to 4 different people to convince them to accept a payment at all, much less one that cleared our outstanding delinquent debt. After spending over 90 minutes on the phone, they finally gave me the amount to pay and accepted a check over the phone... generously (insert sarcasm here) offering to waive their normal $20 fee to accept a payment over the phone. I made it very clear that I wanted to be removed from the modification program and resume my normal payments.
The final insult came by FedEx today, 30 days after this payment of nearly $8,000, stating that we do not qualify for a modification based upon us not making the required 3 "trial payments"; and that we are still in foreclosure proceedings, giving us the options of a short sale or deed in lieu of foreclosure. Really?! How generous of you to keep us in foreclosure since we are no longer past due. So just for laughs, I called the number for my personal account manager...surprise, surprise...I got her voice-mail... Now after 15 months of this treatment, I still never even got a kiss.

I've been applying with BOFA for well over a year to get a permanent loan modification for my rental property; for well over a year I was given the runaround switched to different representatives who would be handling my file, receiving documentation and informing me that I didn't send in this information etc. Same story as everyone else. I filed chapter 7 bankruptcy and was discharged. My account representative David ** informed me that my application was denied due to the Debt to Ratio Income. His answer expenses are to high per the Underwriter. Now, if this was really the case, I should have been denied for this reason last year. This is new news to me. How could my expenses be high after I've been discharged from bankruptcy? This would mean that my expenses would be lower. So, I took this as an excuse to move me along to foreclosure. This time, there was nothing mentioned about lost paperwork or missing documents. There was none as said by Mr. Robosigner, but move to the next best excuse that it was not approved. Oddly enough I have a small mortgage with them, but because Fannie Mae is their investor, they will get 80-100% of the value if they get to foreclose. So their interest is not to help me, but to get the insurance for the property.
Lastly, a lawyer said that before even paying anyone anything, it is needed to write to the State Banking Department Secretary. For PA, it would be Mr. Glenn Moyer. Make sure letters have many facts. Find every piece of paper and you write the representatives' names, time number and information given. Keep good files. If all else fails, contact the bar association for your state to refer an attorney to you. Be careful with these companies that say they can get a modification for you by using an attorney in your state. Get the name of the attorney and look them up with the local bar association yourself. It makes me angry that these "lawyers" and other companies really want thousands to help you; when this money could go towards your mortgage payments.

We lost our HAMP app several times till we gave up in 2010. Wrongfully misapplied regular monthly payments in 2011; they dual tracked us this May, and started foreclosure and prequalified us for the illusory Department of Justice/CA State Attorney General loan modification program, timely applied. We are 3 months behind, originally with Countrywide 2007; disability hardship and $100k underwater. The modification was rejected on 7/9 as not financially worthwhile. The net present value paper used to deny us lists property as $60k more than comps and more than BofA Own Home Price Estimator webpage shows. What’s worse is that they disregarded our monthly reported income and input their own inflated incorrect numbers to show monthly payment 30% of gross info Income.
The HUD hotline counselor was worthless. The BofA rep cannot access anyone to correct their mistakes. We just spent $500 on inspection and appraisal to ask for reconsideration. The BofA executive office will not call or write back. Mr. ** in charge of monitoring banks’ compliance with the 4/2012 court decree is 'waiting' for banks to report loan mod progress after September so DOJ and OCC complaints are useless. The CA State Attorney General has noted our complaint and doesn't do individual assist. HUD Hotline is a joke. Home ownership is no longer a good idea. Don't believe any blogs or ads about successful mods. Just don't pay, don't leave and make every politician pay by complaints and occupy movements.

This is to warn everyone frustrated with BOA. Don't bother with the modification, you won't get one. They will make you resend documents or some documents expire so you have to resign but they keep playing you along. They go behind your back with the foreclosure. They send in your paperwork to the government to get the incentives for giving you a modification even when you didn't get one. Sometimes you end up starting over with the applications three times and re-doing it all over again. Save your time and energy because BOA wants your house so they can triple dip. Even when they just service your loan, they are making lots of money. They don't want to help you and yes, they want your house. But don't ever pack up and leave. They already ruined your credit file for bankruptcy chapter 13 before they put a sale date.
We never missed a payment and we paid online but they forced us to pay by check and never cashed them. We have lots of equity and they moved fast on us, forced us to apply for modification but the whole time behind our back they went to court for foreclosure. We never even got a court date to go. They even sent us someone else's paperwork, but I see people doing this for several years. They took less than a year while I was waiting for a decision for mod. Instead, I got a letter for sale of my house. Do not trust them and it is done on purpose. Regardless what others say, "Why would they want another house?" because they are making more money with foreclosures. Do not trust attorneys that make it sound simple. Also, there are a lot of them that are no better than BOA. Do a background check on them and call the Federal Trade to see if they are for real.

My loan was originated with Countrywide and subsequently taken over by BofA. I receive no information by mail as my information is supposed to be emailed to me. My loan is up to date (actually, I am significantly ahead on payments). I haven't been getting emails for my account, so I go online to check their website. No access is available to mortgage at this time (have tried several different times). Hmmm, it seems that communication needs significant improvement!

We went into Bank of America to refinance a small home loan in order to take advantage of the lower interest rate. We were advised by David ** that we didn't need to report all of our income, because one source was sufficient. This led to the Loan Department questioning us, as if we were trying to hide something. In addition, we were asked at least 7 times to provide more information or sign forms we had already signed. My husband and I wanted to cancel this application, but were told we would lose over $400. I will never do business with Bank of America again!

I was laid off on my job in March and we are barely starting to feel the ramifications. I have since found another job, not making as much as I was previously. We have only fallen one month behind, but they won't accept partial payments and won't make an exception to making half a payment. Then, they want to charge to make a phone payment, internet payment and they send statements 3 weeks after the due date. With them having no customer service skills and not working with their customers, they sure do want people to foreclose.

I was late 30 days twice and tried for a loan modification. I owe $320,000.00 and home is worth $250,000.00. Freddie Mac holds the paper. I was transferred to about every department at BOA. I finally filled out a financial packet and sent it in. BOA said they didn’t receive it. Again, I was put through the runaround for over an hour before they sent me back to where I started. BOA has no problem ruining your credit but has no options to work anything out. They could care less. You might as well just give them the house and walk away because they will have already tanked your credit. Don’t waste your time with them because you will get nothing done.

My husband is disabled and since the beginning of last year, we have been trying to get a modification on our home. Every month, we have filled out paperwork, sent it in, faxed it in and every time we think we are getting somewhere, they want something else. In January of this year, the same process - send, we lost, send, we can't find and so on. Then in June, they sent documents to us trough National Creditors Connection, had them come to our home and then on July 1, said they didn't receive the documents and we had to refile again. We did on July 9 and we were told the process was working, only to find out that they have foreclosed on us on the 4th of July!
Now our case worker, Howard ** at BOA, won't return my calls. I called a supervisor and they sent him an email. Today, he is still not answering my calls. BOA is much of a joke as Countrywide. What upsets me is that we went to Quicken Loans to get away from Countrywide and they sold the mortgage back to BOA and didn't even notify us until a month later. My husband has had a heart attack, is paralyzed from the waist down and with all the stress they have added to us, I am afraid it may take him down further. Is there anyone out there willing to go after BOA for the scams they are pulling?

The mortgage originated with Countrywide. No issues with them; in fact, I preferred them. This was my 2nd mortgage with them. Then BofA took over. I constantly got "do a home loan checkup" ads, and so I finally called them in 2009. The rep I talked to stated I could save about $250/month (on a $2,700/month mortgage), and I said no thanks. She asked why. I stated that after they added $10k in fees, etc. and the loss of the additional equity each month by starting payments over for another 30 years, it just wasn't worth the minimal savings. She rudely hung up on me. It's no big deal until a few months later. Suddenly, without having an escrow account, BofA paid my taxes. I figured it was just something in their system and it would reverse out. Then, several weeks later, I got a call from my insurance agent and she told me BofA was trying to get my policy information.
By the next day, they had paid the whole next year of that too. And it's only October. Neither of these are even due until January. I called them, and it went around and around - ** stories about how the taxing authority requested payment because I was late, etc. I called the tax office, and they said there was 0% chance they would have called them before the tax bill was past due. Finally, I got someone who told me that an escrow account is required when a Making Home Affordable application is submitted. But not only did I never submit an application, I never even inquired about the program. My search at the time showed BofA was getting hammered for not participating in the program when they took their bailout. So now, they were making up applications.
So, I had my own plans of how I was going to pay my taxes (about $10k) with a 0% credit card and airline miles, and I did quarterly billing on my insurance. I had never been late on either ever and never been late on any mortgage in over 15 years of being a homeowner. So now, BofA says, "Well, you owe us $12k. We take cash, check, or money order." After going back and forth with them, I was told that if I can get the escrow deficit paid down by the next escrow review (about 9 months), I could call back and they would delete the escrow account. They also stated that they would refinance the mortgage for me as well and would roll in that year's taxes & insurance.
While in the middle of trying to catch up their error by paying close to $4k/month on my mortgage, I lost my job. But I had made a solid living and was pretty financially responsible. I continued to make the payments and catch up, until I had covered it all. As promised, they deleted the escrow account. But they wouldn't refinance me, because now, I didn't have a job. But I did. I was day trading in the stock market and making just as much as I always had when I had a job. They wouldn't accept that, because I didn't have 2-year history. So now, I figure, I might as well take advantage of this whole modification thing, since I'm considered "unemployed."
First, they said I couldn't apply, because I had already turned down their service (when they made up my application). Once I cleared that hurdle, I continued to get turned down for complete ** reasons. Finally, a rep at BofA said, "As long as your current on your mortgage, they won't accept you." So, I skipped 1 payment in January 2011 and waited 30 days. Sure enough, I'm now eligible to apply. I went through the process, yada, yada. They lost my paperwork, said I didn't fill paperwork out right, etc. It's the same as everyone else's, except in every instance, I proved to them that I did. I cooperated and was timely every step of the way.
Then I got to the final stage where it goes for approval, and it just simply stalled. Nothing, until suddenly I got a certified letter from BofA's attorneys saying my property was going to be sold. After several calls were escalated, the system "auto-generated" the foreclosure process, because my package was incomplete by the due date. But the rep, who was working my case, "forgot" to scan the last set of documents into the system and caused chaos. Note to anyone still reading: If this happens, get an attorney. Once their law firm - which is just a fancy collections office - gets a hold of it, it's almost as good as gone to the courthouse. Trying to get it pulled back takes extreme measures, which I did. I won't go into that detail, but I'm still in their process today with another foreclosure date set for August (Yes, 2 years later.).
The government modification process is bad, but not even close to how bad BofA's own "modification" process is. No one calls you back, even 3 or 4 supervisors up the chain. They can't interpret basic financial information, and they simply must all be smoking crack. Seriously, these people are either high or retarded. This was the beginning of a death spiral that contributed to and has left me broke, stressed, depressed, suicidal, soon-to-be homeless, and soon-to-be divorced. Bank of America needs to be shut down! Enough empty promises and unethical practice and misuse of "my" money as well as other hardworking taxpayers'.

We recently filed with Bank of America for loan modification. We went through two loan officers and were denied. We are only a month behind and have been a month behind for a few years now. We were looking to put one payment at the end of our loan and keep the current mortgage payment as is. We were denied. We are not looking to get out of our responsibility, just looking to work with the bank. They said they were there to help us out. After filing the same paperwork twice, we got a "no". Thanks, Bank of America, for working with us.

Since May 2012, we have been trying to resolve and track missing payments (yes several) dispute to no avail. We sent docs they claim to never have received proof of payment records, fax records, USPS records, etc. To make matters worse, they are threatening to foreclose when we have not missed the payments they claim. Their own employees can't understand "or explain "where our payments are going.
I saw another, very similar review posted here. Is this it? We just post to no avail? I have reached out to HUD, BBB, CCC, FHA, and it seems will now be forced to seek legal support in this matter. Those of you that have applied for the loan modification and find it to be a hoax, add me to the list! We were told we were missing documents, yet there has yet to be anyone that can explain what document is missing. "Go figure." To me, it’s a way to assure we all fall on our faces and the bank gets to run off with all of our missing money, only to ruin our credit ratings while pretending to have a program in place geared at "helping” people retain their homes. In fact, it is just the opposite.
I'm tired, frustrated, yet determined to fight. I work hard for my money and I've invested too much in my home to let them steal it from me. Hopefully, I can get resolution from one of the agencies that may still be honest. It's sure not B of A. Good luck all.

For 2 yrs of trying to get a loan mod, I am exactly where I started, giving the same info and financials to 20 different people that are going to send out my package so paperwork can be signed and returned. And for 2 years, I have been waiting for this package along with many of my calls being transferred to a generic voicemail. The end result, the only calls I receive back are about being in pre-foreclosure. We were told we had to miss payments to qualify, then it was, we could be put on a 6-mo. program. Then when payments were made, they were not put towards my mortgage! Ask me where that money has gone? I have no answer because they still have not given me one. They are obviously not the brightest people. My house has a $320,000 mortgage left on it and is now valued at about $180,000. I never thought it would be so hard to keep a home that is considered to have an upside down mortgage. I can now understand why so many walk away. If anyone has info on an actual person to reach with somewhat of a financial background, please let me know.

We put our house up for a short sale and received an offer right away. We filled out everything BOA wanted and we have been working with an attorney with our realtor that does this full-time. After 2 months of going back and forth (mostly just begging for them to assign us a case manager and start things moving), we received a notice that our mortgage is being sold and they are no longer working on the short sale process. We now have to start the process over with another bank and cross our fingers the buyer will stick with us.
How can a bank sell a mortgage where a payment has not been made for over 3 months? Hopefully, this new bank will work with us; otherwise, we will most certainly be looking at foreclosure. We thought we were trying to be good by short selling our house instead of just foreclosing and trashing it. We are in this situation because we could not refinance since we have been working 4 jobs to make ends meet after we were both laid off from previous, much better-paying positions. Those 4 jobs barely cover our expenses but make our income too high for us to qualify for refinancing. If they took into consideration our second mortgage, we could easily qualify. The whole system is out of whack.

I have been trying to get a modification with my lender Bank of America. It's the worst process I have ever had to do. I have turned in the paper work RAM three times since May and all the other paperwork they ask for. Every time I call, they never know what's going on. It's so stressful and it's supposed to make it easy for us. Not a bit! I have had three different case managers. Nothing has been done! At this point, I don't know what to do! They just don't care about the customer!

Loan w/ Countrywide was sold to B of A. I tried to do a modification. I was told they were working on it. Three days later, it was sold at auction without notification even after the bank had called us 3 days earlier and told us they were working on modification. I have elderly parents in the home. Our entire government is corrupt.

I hired a company called Consumer Advocates to help me with my loan modification. They we're very nice and eager to get things done. I paid them $2,400 and I never heard from them again. I decided I would work with BoA myself and wouldn't you know it? They are doing the same thing to me. I'm only 4 months into this dealing with BoA myself. I have read so many of your stories - it's scary. They won't return calls, even if I make an appointment. They asked me for proof that I was unemployed. What’s that all about? I have a long road ahead of me, don’t I?

My residential loan is held with BOA. I was 60 days behind and they started foreclosure on me. I was put into modification process in April 2011 and didn't get the package until July. I submitted the package. They denied me saying I didn't give them all the info. BOA referred me to Trott & Trott, their attorneys, of which the attorneys sent me back to BOA. I applied for modification a second time in the fall, left several messages and the rep wouldn't call me on my cell, only at home and I could never get her. I have faxed document proof of everything I sent them. She cannot find evidence in the system.
On 6-26, Paquita said I would have to start the process all over again and she would send me a new application. As of today, I don't have the package and now the loan has been sent back to Trott & Trott and a sale date has been set on my house for Aug 15th. All I want to do is modify my loan and keep my property. The property is worth only $144,000 and I owe $265,000. Why won't they work with me? Their business practices are unethical and they won't follow up. I've escalated to Paquita's manager, his manager, her manager and all the way up to Terry ** and his admin assistant. And no, I haven't had a single returned call. This is out of hand. BOA has ruined me, my credit and now I risk losing my business because of them.

To all those that were forced into a short sale by Bank of America, you need to know that the terror has only just begun. I have been attempting to work with them on a short sale. An offer was made that is more than the appraised value and they have not responded, the offer has expired. Numerous calls from me and my broker and still, no response. I have contacted the attorney general. It seems they (BOA) prefer foreclosures (based on other folks' comments) over short sales.

FHA HAMP: I have been attempting to modify my mortgage with Bank of America since January 2011. It is now July 2012, and nothing has been resolved. I have been put through the "3-month trial" 4 times, each time being told afterwards that the representative must have done something wrong because there was not a record of me being placed into the trial program, only special forbearance. Every time I seem to be making progress with them, I receive a letter telling me that I have a new account manager. When I contact them, they essentially make me start the process over every time. I can't even tell you how many times I have submitted documentation to them. My home isn't worth nearly what I owe. If I were to walk away and let them foreclose (My credit is already ruined, so why not?), they would certainly lose money. I cannot understand why it isn't in their best interest to work with me! This is a nightmare. I doubt that I will ever purchase a home again. This is not worth the stress and tears it has caused me.

First, I believe I was the victim of predatory lending. BOA was the lender for the condo community. I was told that to obtain specific buyer's benefits, I had to use BOA. This was my first home purchase and I have no previous real estate experience. I never missed a payment until my company closed in 2009. I notified BOA before I even missed a single payment. I immediately tried to arrange a reduced payment or partial payment. The job climate in my industry meant I was facing long term unemployment. BOA would not consider the request since I was still current. While unemployed, I made several attempts to resolve. I was initially told that unemployment income was not considered income. Then as my benefits were about to expire, I was told that BOA would consider the unemployment income, but that mine would not be considered since it was due to expire shortly. They had the nerve to ask why I didn't just get a job.
Desperate, I accepted a position that requires me to commute up to four hours a day since BOA said I would be eligible if only I had verifiable income. Now that I am employed, they are denying me because I can afford the mortgage payment based on my current salary. This is true to a point. BOA is failing to factor into the decision that the only option they have given me on the past due amount and penalties is to pay it off over a 12-month period. This would more than double my mortgage payment and I would have almost nothing left for other living expenses. My condo is worth about 1/3 of what I owe and I can't understand why BOA won't let me work something out.
I have received a lot of communication from BOA, but nothing that clearly describes the basis for denying my requests. I feel sick, depressed and angry. I've cried too many times to count at this point. I want to pay. I want to stay in my condo. I want to meet my obligations. I have 30 days to move based on the foreclosure date. May you burn in hell Bank of America. I will never recover from this.

We went through all of this stuff. I researched the HAMP program when I heard it on the radio, that there were billions of dollars that President Obama has put together for the HAMP program to help the US. I then contacted a HAMP counselor. The counselor went through everything with us. She then contacted Bank of America for us. Bank of America contacted us, we sent in all documents they requested - tax returns, hardship letter, mortgage statements, pay stubs, etc. I have names, phone number and fax numbers to prove we did as they asked. They sent all information to the underwriters. We were approved for mortgage re-modification. They told us we had to pay the set amount with the coupons they sent. After the payments were sent in and cleared the bank, they would follow up with a mortgage loan modification.
We sent all coupons in. They cashed the checks. Then, we started getting mortgage coupons sheets (like we have been for several years), but none of them had an amount so we continued to pay the amount they told us to pay and waited for the new mortgage papers to show up. Well guess what? They never showed up. They cash our check every month. When I called the number I had for the mortgage refinance department, they never return calls. Now we got a letter saying we are not paying the full amount of the mortgage payment and they are going to start default action by July. Every time I call the numbers I had, they will not call back.
We finally got a hold of the people on the letter and they told us to send the information again, so we did. When I called, I got a different person in charge of our accounts' voicemail and they never called back. I would like to point out that we were never behind on our mortgage until we listened to them. I have researched Bank of America re-modification scams and have read hundreds of people going through the same thing. I am so sick to my stomach on this whole matter and it gets crazier. Now they are not accepting our checks. No matter what we send them, they send us a check from Bank of America, not ours, and it is never for what we sent.

My realtor and I started a short sale process on my home in January 2012. In March, I was notified that my case was closed for lack of communication with my account manager. We had tried (and had documentation) of us trying to reach her several times in that time period. Calls were never returned by her. I had to go through customer service to get my case reopened. Since then, I was approved for short sale, submitted all of my paperwork as requested. We didn't hear anything for a while, so we tried again to contact my rep with no success. Again, I had to go through customer service. We have had to submit paperwork over and over again to my account manager and to the short sale department (like they are completely disconnected!).
Then they did their inspection, came up with a listing price for my home. I recently obtained an offer from someone, the bank countered 3 times with the final amount they wanted being $7,000 over what they said we could list it at! The buyer wasn't approved for that amount. It took them 6 more weeks to come to that decision. More wasted time! I tried reaching my account manager, got voicemail, as usual. Another rep answered and wanted to update my personal information. She had contact information from 10 years ago! What happened to all the info that was submitted within the past 6 months? I still have not been able to reach my rep. Now, it's down to the final days and it will be going up for auction or foreclosure. No wonder there are so many foreclosures. I feel sorry for anyone working with Bank of America mortgage. Their customer service is worse than any business I've ever dealt with, and I'm in my 50's. Good luck!

It has been 6 months that I've been talking with Bank of America and now that they have all the paperwork needed to proceed with my loan modification, there is no help, no return phone calls for the past 3 months from any reps from BOA. Its a joke. They have a person in charge of the loan that never return calls, then they say if I didn't return the call within 24 hours, contact my manager. The managers are never available and never return any of my calls. It's horrible, frustrating and upsetting when the government give these banks so much money to help these loan modifications and Bank of America does nothing to help. It's sad, but they do not care about you when you can't afford your home. I've been a customer for the past 13 years and I'll tell you, they are the best bank when you are paying. Then just for the past 6 months I've been in default with my mortgage, so far, there is no assistance.

I have been waiting for over 2 years for BOA to finalize my loan modification. After 1 1/2 years of waiting (faithfully calling weekly/monthly), they informed me that FHA regulators found errors in my loan modification paperwork and that I needed to redo the paperwork and pay $100 more a month in mortgage payments. This was in March 2012, still no finalized paperwork. They have been reporting that I am in foreclosure for this entire time and refuse to change their report to the credit companies, although I have paid on time for the last 2+ years and done everything they have asked me to.
They have come by my house and taken pictures of it while my children are outside playing, and sent me numerous foreclosure documentation, phone calls, etc. But when you contact them about it, they say "No, we just haven't updated your loan yet. You’re not in foreclosure". I cannot refinance my house or sell it because my loan is in limbo. Bank of America is holding me and my family hostage, harassing us, causing us great turmoil and anguish and no one can do anything about it. This is un-American. How can this company have so much power over millions of people?
I have actually gotten to the point of where, although I can afford to make my house payments and live a comfortable life, I am considering walking away from my home because of the stress and harassment that I receive from Bank of America. For me to say this is a huge deal. I worked my tail off to save money to buy my home and provide a home for my 4 children.
I am a single mom who does not receive any child support or other support and I was so proud to have accomplished this goal. Bank of America has taken all of that joy and pride away and is showing my children that Corporate America is able to destroy the little person very easily. It's a shame that Bank of America is not really the Bank of the American People. They are the Robbers of the American People's Hopes and Dreams!

The loan was officially lock-in on April 18th. ** from Bank of America called me on April 24th for the first time to inform me that she would be handling the management of our home loan. I tried to express to ** that this kind of loan was not a regular loan because as I understood from my agent, this loan may require careful, detail-oriented attention. I also informed her that I would be fully available to help with any necessary paperwork required to complete the process. Additionally, I expressed to her that I was under a very tight timeline, especially considering that I needed to move out of my current residence by the end of May. In particular, I clearly expressed that my wife and I are currently under a lease agreement stating that we were required to move out of our current residence by the end of May.
I was under the impression that we were in agreement as to the importance and urgency of this process, yet I have been very dissatisfied with **'s performance, as well as her lack of availability in completing the process. In order to help you understand my frustration, however, I would also like to include the following timeline of events: I talked to ** over the phone on more than two separate occasions since April 24, 2012. I talked to **, her manager, on more than three separate occasions to inquire about **'s performance. Perhaps it is possible that ** is busier than her manager or that she simply has weak communication skills, but I cannot be sure at this point. I called ** more than 20-30 times, but I could not reach her directly and she did not return any of my calls. I also left multiple voicemail messages over this 30-40 day time period.
So at this point, I began to wonder whether ** was purposefully ignoring me. If this is the case, this sends the message to me that the Bank of America ignores its customers. May 22 was my closing date with Bank of America, it did not happen. The HUD closing date was on May 27, 2012, ** could not finish. The worst scenario, according to **'s manager was that the new closing date would be May 29, but ** came up with a new list of 9-10 required documents. One of these documents was supposed to be completed and submitted by her. For instance, she was required to submit the homeowner association certification. ** asked ** to request that from the title company by May 24, 2012. However, I received no word about whether ** had actually followed up with this item.
Another document was the power of attorney. I emailed ** the POA on April 30, 2012. To my great disappointment, ** discovered that she had uploaded the wrong file on May 29, 2012. As a subsequent result, the entire set of submitted documents would have to go back to underwriting process in the waiting queue. Whenever I ask ** whether my documents were fine or I need to make any corrections, I was unable to receive any answer whatsoever. Again, such service forces me to ask a simple question: Is this how Bank of America satisfies its customers? There are some more items I will list, but I am tired of it. In summary, Bank of America promised me that they will close by May 22, 2012. But today is 7-10-2012 and my loan is still not closed. I am just tired of Bank of America. If you're ready to face similar action, you may try to get loan from Bank of America. Have fun!

I have been going through the modification process with Bank of America for 2 years. Finally, in March 2012, the fair housing department in my area got involved and we got the modification. Bank of America wanted 3 payments upfront due to the mod package being delivered to the wrong house. The mod actually should have gone through in December. We made one payment right away and have been trying to catch up since. In June, we made our April payment over the phone to Michelle **, who told me the amount the payment should be $2,667.76. On June 22nd, we received our payment back stating "We received a total of $2,667.76 to be applied to your loan; however, this amount does not represent a full monthly payment. We are unable to accept partial payments on your account." The letter stated the monthly payment should have been $2,774.08.
$2,667.76 was the amount I had been sending since the mod went through. It is the amount on the statements. I then phoned Bank of America and after several voicemails, was told to deposit the check and remake the payment. Starting on July 2nd, I was trying to contact someone from Bank of America to make my April and May payments. Left several voicemails with several people. Finally, I got Michelle ** on the phone on July 10th. She told me my loan was in foreclosure and couldn't accept any payments. I then talked to a manager who told me Michelle ** should have known the correct amount of the payment when I made it, but there was nothing he could do at this point. We were 4 months behind and that puts us into foreclosure.
The payment should not have been sent back and if it wouldn't have been, we wouldn't be 4 months behind. I told him that I could make 2 payments at that point and he said he couldn't accept it, but he could speak to their lawyers to figure out another payment plan. He would get back to me in a couple of days! We know how that goes. If my April payment would have not been sent back, I would be 2 payments behind and able to make another payment in 2 weeks. It seems as if they are playing games. I am constantly shuffled to different people who say they will get back to me and don't. I don't know what to do at this point. I just want them to accept back the payment that should have never been given back in the first place and take my May payment. They are making it impossible to catch up.

I kept calling and calling and getting no one and leaving message after message. When I do get someone, they all tell me different things. I wish they would record and note what was said so I don't have to go through everything again, again, and again. I've been told I will get a package in the mail. Well, I'm still waiting. Actually, after many calls, another rep told me how to go online and complete and send in ASAP. I did complete and put 6 stamps on the packet and in the mail it goes. I made a copy, called BOA asking for a fax number, after purchasing a fax only to be told, I don’t qualify. I told the rep I don’t understand how I did not qualify. I just mailed the documents today.
I told the rep I just got papers to say, BOA is there to help. They listed different ways but I don’t qualify. BOA is the worst! No help. I really think they are trying to collect as many homes as they can. They are trying to set a record of swindling people out of their homes. They ask you to complete all documents to tell you, you’ve missed something on, and on, and on. Then, they take your home. This means nothing to them. The reps must get a bonus every time they do a reject. BOA? They are the worst!

July 6, 2012: Sixteen days later, the FedEx truck pulls up with another overnight letter containing more documents for us to fill out for Bank of America sent by Elise **. With the exception of one form, all the rest were sent to her in the last month. My husband has all this down to a science and mechanically just reproduces the information, changes the dates and we sign. The little crazy person in me would love to be part of national riot right now. This is NY and in this state, BofA can't touch us unless there is a ruling by a judge. BofA doesn't have anything on us that will look good for a judge. So we wait and wonder when someone will ask BofA what they did with the TARP money, our tax money, the government gave them.
July 9, 2012: A few hours after posting about July 6, I got a phone call from Blanca (a new name) who was calling as a debt collector from Bank of America from the office of Elise **. They called me but ask my full name, social security number and load number. I told Blanca that we are doing what Elise asked and the papers were on the way again. She connected me to the voicemail of Elise. Even though they called me and I ended up with a voicemail, I told Elise, or whoever got this message, that we're cooperating with their bosses and to get on with their life so I can get on with mine.
I should have left a message for Elise which mentioned information I read on http:**. B of A corporate culture and management style is a health hazard! If you subject people to a stressful environment, they will behave and decline as such. This is counter-productive... ding, ding, ding! It's HR 101, for God's sake! No human being can be expected to effectively produce under these conditions long term. During my brief employment, I took notice to the overall health of those who had been there for more than five years. Obesity, COPD (which can be a terminal illness), high blood pressure, fibromyalgia, bulging discs, sleep deprivation, shingles, prescription narcotic addiction and worst of all, an extreme sense of self entitlement. One way or the other, the constant stress from unreasonable expectations for production will eventually kill you.
There was more. It's important for leadership to recognize bullying in the environment by leadership. If you take a look, you will see unusually high levels of the following: staff turnover, sickness absence, grievance action, disciplinary action, stress breakdown, suicide or attempted suicide, death in service, customer complaints, ill health retirements, early retirements, and reorganizations.
Blanca and Elise at 1-800-669-6650 in Texas should be aware that Bank of America was given money, their tax money, to end the mortgage crisis. B of A and Brian ** have not exactly been operating in good faith. The property is in NY and it's the law that all this stuff has to go in front of a judge. I wish nothing but the worst for Brian ** on his summer vacation. While he and his types spend our tax money, there are people without homes and have no idea what the future will bring.

I have a home loan through Bank of America. They said if they don't receive my payment by the 1st of each month, they will have collections call every day until they receive payment. They said the grace period is until the 16th of each month before there is a fee added; however, they start calling you on the second of each month to ask when the payment will be made. This is harassment.

Despite our constant request of consideration for an adjustment in our high mortgage rates when my job was being reduced from 40 to 36 hours, my family and I have been stonewalled each time. I am taking a great deal of call at my job in an effort to keep up, but this income is not guaranteed. They tell me that I do not qualify for any of their programs based on my income, but if they eliminate the call time, they tell me that we cannot afford our home. We have lived in this home for 6 years and have missed 2 payments. This occurred during my transition from a 40 to a 36-hour work week nearly 2 years ago. We have spoken to multiple people in this organization to ask for their assistance, but we have been shuffled from person to person with no consistency of effort. In fact, we were told by one representative that we should short sale our home. It is our family’s intent to raise our children in this home and to grow old in it. It is the reason why we purchased this property in the first place.
We have been told that the qualifying point for many of their programs is being behind three months or more in payments. We are not willing to stop paying our mortgage and ruin our credit to qualify for relief from what we consider an excessively high interest rate in the current housing market. Bank of America has also suggested a repayment plan which would require a significant increase in our current monthly payment over a 12-month period. If we are asking for assistance with our rate that we are now paying, how can we afford to enter into a contract which would require us to pay more? This is a recipe for financial disaster.
Additionally, even though the aforementioned payments were missed nearly 1 1/2 years ago, Bank of America continues to reflect this on our credit as if the missed payments have occurred within the last 2 months. My wife and I have a folder that is 3 inches thick from all of the calls we have made and the threatening foreclosure letters that we have received from Bank of America. Bank of America was not forced to purchase Countrywide (our original loan holder), but they should be willing to help those that entered into questionable ARM loans like we did on our second mortgage when we originally purchased this property 6 years ago.

BOA is a joke and has done nothing but our lives a nightmare for the last three years. We were a Countrywide loan that was bought out by BOA. When they took over our loan, our mortgage almost doubled. At the time, we were in the midst of a re-mod with a variable rate going into a fixed rate. We were guaranteed a 4% rate which ended up 8.65% (guess that was better than the 14.25%!). This process we were informed would take approx 3-5 mos. Right? Try 1 and 1/2 years to complete (while we still had to pay the 14.25% during this time frame).
I currently have a file folder that is over 4 inches thick of proof. They suck and one hand doesn't know what the other is doing. They lost our application three times, FedEx'd us someone else loan application, and continually claimed they never received faxes or information from us. Hello? I faxed BOA from BOA. The settlement dept. is informing loans to remain at least 2-3 months behind, in order to remain eligible. (Do not do this.) Then, they turned over our loan to some lawyer and started foreclosure without notifying us.
We received a letter dated 6/28/12 from the lawyer's office that we are in foreclosure and a short sale will be put on our home in 30 days time? The next letter we received dated 6/29/12 was from BOA station our loans is with their review committee, and that it doesn't mean that our home is in foreclosure. So, I am going round and round yet again with reps with no clue as to what they are doing; back to sending e-mails to 3rd party advocates, a division of BOA that has no phone number, e-mail only; back to "We didn't receive you fax, ma'am," though I have the confirmation page from your own freaking bank.
I am going to lose my home due to ignorance and neglect of BOA. I only did what I was told on a recorded phone call that there is now no record of. They're a bunch of snakes. Instead of doing the right thing when the government bailed your monkey butt, you screwed the little guy.

BOA is the worst ** bank ever. Their mortgage employees fail to answer their phone and calls are not returned in a timely fashion. No one takes ownership for anything and this bank cannot meet the 45 to 60 day time frame that it takes when closing with an FHA loan. We are going on 80 days and have surpassed 5 closing dates as BOA is negligent. The CEO, Abu Imtiaz says, "It's not BOA's fault that you're not closing today." Well actually, it is BOA's fault as your company failed in the following areas:
2. Your underwriter failed to understand simple account transactions on bank statements forcing us to withdraw money from our 401K account causing us to incur $200 in fees.
3. Your loan officers have numerous times requested that we resend them documents that were sent 2 days after we applied for the loan.
4. Your loan closer failed to provide the seller/buyer lawyers with closing estimates & wire information prior to the closing deadline.
Due to BOA's disgusting way of operating, my fiance and I have spent numerous hours chasing many different BOA workers. We've had to pay for a storage unit to store our belongings as his apartment lease was up. We've taken a loss for the truck rental, and we've inconvenienced my new tenant delaying her move in date. BOA should be sold to another bank and their entire Mortgage department personnel should be overhauled with trained, knowledgeable, competent individuals who can comply with the 45 to 60 day time frame that it should take to close on a home. Consumers should not have to endure this when purchasing a home. This bank will suck all the happiness out of buying a home. They will make you never ever want to buy a house. Run from this bank!

I got the bright idea one day to walk into a branch and ask a question about my mortgage. And so I was faced with the burning question from one of the employees how did I know I had a Bank of America mortgage. She found nothing that said they held the mortgage despite the fact that I gave them the loan number. This was in my home state of CT. Second time I needed help, I went to Bank of America to have a document notarized. They don't do that there. I went to the bank across the street and they did it and I didn't have an account there. Third time, I went to Bank of America I had a serious issue, talked it over with the account representative and so she gave me the same generic answer I got on the phone. No help.

After repeatedly being told they couldn't help me because I was current on my payments, they put me into a modification program without my knowledge. After five months of not letting me make payments, they denied the modification, leaving me 5 months behind with with my credit ruined. How can this be legal?

I used to work in the Bank of America foreclosure department and was always shocked to be processing loans that were in the foreclosure process for years. I left Bank of America and two months later, my husband was laid off. I tried to get a modification and was told I had too much debt for Bank of America to help me. They then put me on a 3-month forbearance in which we were never late with a payment. I was then told to stop making partial payments because they won't be applied and apply for MHA. This was in September 2011.
For the first few months, I called diligently for status and was told my application was being reviewed by underwriting. Eventually, it went to calling once a month. Now I don't bother to call at all. I get a different call once a month from someone who says they are my loan representative. It's never the same person and their voicemail says they are only available from 5-7PM. Even these calls went unreturned. I'm to the point where they can have the house. It's not worth the stress. My credit is ruined. I'm in a workout code in their system, yet they are reporting to the credit agencies that my payment is a year behind. It makes no sense to me. I just want my unapplied funds back so I can pay to move out.

For nearly a year I have sent numerous QWR to BofA requesting the identity of the lender whom they purportedly represent. To date, they have identified three investors. Wells Fargo (who has sent me a letter denying they are my lender and confirmed they are the Master Servicer of the Trust my loan was thrown into), Trust GSR2007-0A1, and Deutsche Bank. None of these entities are a true lender of my loan as they have not paid value for it and it is not on their books. Further, I never received a notice of mortgagee transfer (as required by FDIC 226.39) indicating that I ever had a change in lender after Countrywide. I have not made a payment since October 2011 and have no intention of doing so.
So my loan sits in limbo and with each phone call I receive or form letter simply stating one of the three entities as my investor. I fire off another QWR stating that until they provide real documented proof as in the form of my original loan documents showing all endorsements of true sales, I'm not paying. I will not play their game and ask for a modification or refinance as they have no authority to take any action against me. Homeowners need to understand this and start not paying on the principal that BofA has absolutely no proof of any such sales or any such lender. They have only a photocopy of my original loan documents which is worthless.

Modification paperwork was submitted multiple times. The CRM (customer relationship manager) was on vacation, sick, had family illnesses, or simply does not return calls, conflicting letters and conflicting statements from BofA employees. I received a letter stating that my modification was denied. Then when I called and spoke to my CRM, I was basically told to just ignore that and continue to submit the paperwork.
I in good faith continued with the process, thinking that I would soon get some relief. (My income was cut in half after a layoff in 2009.) This has yet to happen. My home is now in foreclosure, and I am now attempting to pull it out by paying past due balances and fees by any means possible! One positive note, the employees in the foreclosure department seem to be far more qualified and are much more consistent than any I have spoken with until now. It's a shame that it had to get to this point in order for me to gain a clear understanding and try get things caught up. After a ten-month modification process with BofA, I am ready to throw in the towel!
Notes to those still dealing with the process: 1) Every document submitted must have your loan number written on it; otherwise, the docs are immediately disposed of. 2) CRMs will call you back within 24 hours if you speak with someone in the foreclosure department and you ask them to send your CRM an email. (An employee with the foreclosure department shared this with me, and it worked twice!) Good luck! You'll need it!

I was laid off in March of 2011. As soon as I found out I would be laid off, I contacted BOA only for them to send me a nice letter to say, “We can't help you. You should consider a short sale.” For almost 10 months I continued to pay $2,000 a month for mortgage and had to take money from my 401(k) to pay and they continued to say they could not assist me. I found out about a company that was having meetings to help people that are experiencing hardships and need assistance. I went to the seminar and was there from 8:30 am until 5:30 pm. I finally made it to BOA tables and they tell me that they can put me on forbearance for 3 months, only to tell me again, “Sorry, because your loan is FHA-backed, you will have to continue paying your normal payments and FHA will contact you in 15 days as to if they will agree to the forbearance.”
On December 5, 2011, I contacted BOA through the website as agreed upon on January 1st and 15th and there was no response. On January 23, a Heidi called me to say that I can pay 1/2 the mortgage payment for December, January, February and will be reevaluated in March to see if I meet the modification requirements. She stated that this will not impact my credit report. Needless to say, I asked if this is my modification, why was I not sent any correspondence to these terms? She stated I received a letter. I never received any communication. If I had, why would I have paid the $1898.65 for December and January? I asked to have the correspondence resent and to this day I have not received a letter. I sent document after document and was advised that they never received any of the documents. I produced fax coversheets, resent documents and to no avail. I heard nothing. I made phone calls, sent emails and there was no response. I even called the supervisor and I have yet to receive any letters.
April came and I got an advisory from my credit watch that BOA has reported that my mortgage is 2 months behind and I got a letter that if I didn't pay a large sum of money by June 9, 2012, my house would be accelerated through the foreclosure process. I called BOA and spoke with Heidi and another gentleman in the modification department. They told me that the loan department and the modification department are separate and that they don’t know that I am going through this process and to disregard notices (certified mail). They certified mailed me the foreclosure notice, but they couldn't send me a modification notice. So, they finally sent me an email through the third party that my loan modification has been denied and that they will send me a letter. That was on June 14, 2012. Can I say I have yet to receive a letter, a notice, or anything?
I did receive another email from the "loan department" stating that my house was moving to the foreclosure process, although I paid the outstanding amount that they said I owed on June 1st. What in the world! Oh, I forgot to mention that Bob stated he doesn't know why Heidi would tell me that this would not show up on my credit report. So, now in my search for employment I cannot get a job in my field because of my poor credit rating due to BOA. I even tried to call another company to see if they could try to refinance me and was told even though my payments are current, they are unable to assist me because BOA has reported that my payment was late for 2 months and my credit scores are in the toilet. How can these companies get away with this? What can I do to keep my son and I from being in the street? Why is it that honest people trying to do the right thing are put on the street? I paid every month, never had a late payment in 8 years until BOA advised me to pay the 1/2 payments and this is how I am treated as a customer?

Bank of America does not even consider refinancing my loan. I have been on time with my payments from the first day I got the loan for the past 5 years. My interest is 6.75%.

I went through nearly 10 months of the modification process with Bank of America, including 6 months paying the partial payments they requested. I was told that the final papers were being prepared in May and to continue making the partial payments until I received them. Today, I got a FedEx letter stating that the modification was denied due to my "not making the partial payments." I notified them three times in the last 5 months that indeed I did make the payments prior to the due dates, and I have bank statements to verify that. I just sent an e-mail to the person I have been working with at Bank of America, stating this same point.

I applied for a simple refinance in March 2012. I provided all documentation required at that time. I paid for an appraiser visit and waited. During that time, the processor involved with my loan contacted me once. Her name is Gladys **. I made repeated telephone calls to Gladys without a response. I then emailed the original contact person, who worked with me on the application. I was requested to fax all of the details I had already provided (all signed forms, tax forms, pay stubs, bank statements), which I did. The primary contact, Lisa ** attempted to forward these documents to Gladys. I did not hear back. Due to time passing and not hearing from BOA, I called and emailed several times only to receive a short email from Gladys ** that additional information is required from me or my loan application would be cancelled due to the length of time the application was open.
The information requested was information I had already provided and information that Gladys **'s co-worker had forwarded to her. This is now 90 days. Lisa ** has a new job, Gladys ** has a new job and I still am no closer to closing my refinance. I reached out to Lisa **'s new boss and old boss, both of whom stated they are unable to help me at first. Then due to 90 days passing because of Bank of America's error and oversight, I am then forced to provide yet additional documentation to them for me to save approximately $100/month by refinancing. They want 2011 tax returns, 2010 tax returns, 2009 tax returns, to pull my credit report again, detailed letters explaining deposits into my bank account, an additional three months of bank statements, additional two months of pay stubs. Again, I provided the details to them. I then decided to copy the President Brian Moynihan on my email because my frustration is escalating to the point where I don't know what to do.
I just want to make my life simpler and hopefully, be able to afford heat this year while looking for a second job so I can keep my modest home without falling behind in payments. I need assistance, someone who can help me finalize this nightmare of a loan yet no one within Bank of America seems to care about their customers.

Much like all the other complaints I read, BOA clearly botched our modification request and we were denied for not submitting the required documents. All of which had been submitted many times, 3 or 4 times. The gauntlet they send people through is clearly their intent and they should be held accountable. We have filed a complaint with our state attorney general and hoping for some small piece of action. Our request was started at one of the outreach seminars, which I happen to see on the local newscast that morning. Thinking I had nothing to lose, I went hoping not to stand in line for too long. Surprise, I was there all day and 1 of 6 total people who attended. There were at least 25 BOA people there all sitting in a conference room with laptops in front intently looking at their screens. Who knows what they were doing? That was the start of missed phone calls, FedEx at my door with next day deliveries (then the exact same documents would come to the post office in urgent next day packages) and many other aggravating actions. I have to stop, otherwise I could talk for much longer with details of a botched process by an incompetent organization. Too big to fail? I don't think so.

BOA makes their own rules that not even my lawyer has ever heard of. I had an insurance claim and a check was made out to us and BOA. I went to BOA to have it signed and they took my check, and said it must go to California and an account set up to take care of the repairs. Most repairs are done and they are waiting for payment. They said, "We do not take the insurance company's word" and need to send their own people. They also said they only let 30% at a time go from the check, so they make interest on my insurance check and put me through hell. All they have to say is we did it wrong and we should have called them first, not the insurance company. What a joke. When all of this is clear, we will be looking for a new company that will let us know we are not a number but in fact, a person.

My mortgage payment was short about $100. Computer program sent wrong check to the bank. It was a legitimate error. Bank sent late fee nine days before notice of inaccurate amount received. Bonus to bank was $96.41. Bank will not send new statement until previous charges were sent in full. This smells like entrapment for the customer not on top of things. In the last 15 years, my only service charges have been to BOA. Talking with BOA telephone reps is like talking to my dog. They are totally incompetent and you need to talk with ** but not available. I plan to contact my financial people to get a new vacation home loan, even if it is at a higher interest rate. Dealing with BOA has not been a good experience. It's only a matter of time before they hit the dust. I have not addressed previous problems with this bank. They will suck every penny from you that they can.

For two and a half years, we've tried everything we can to modify our mortgage which is necessary since the company my husband worked for closed in 2009. We have filled out reams of identical papers numerous times, tolerated constant harassing phone calls, recorded conflicting statements by them on the telephone and have collected letters of clashing statements. We even have one that says we did not get a modification because we are not in default; however, they had us in foreclosure status at that time. In Dec. 2009, we were verbally given an amount to pay as our three-month trial period payment which they accepted from us for 11 months.
After nearly a year of accepting our check, BofA contacted us to say they will not take any payment at all so every month we put our payment in escrow. Were it not for BofA, our credit would be in great shape and we would be contributing to the economy. Repairs on the house and purchasing a new car have stopped until we know where our life is going. Our lawyers have written letters to Secretary of HUD and I wrote to President Obama. How does BofA get away with it? The Federal Government gave them money, our tax money, to help them with people like us. We are 63 and 58 and are starting to experience health problems from stress and very little sleep.
On June 18, 2012, FedEx delivered a package of new set of papers for us to fill out. The papers came from Nichole ** (a new name to us). We will fill all the forms out again but we recognize the papers as things we've done before. Six hours after I posted on Facebook and my own website went online, I got a call from Steve **, (a new name) and a person who said he understood and would put out matters in the fast lane. He told me I would hear from someone within the next 48 hours.
On June 20, 2012, we just got a FedEx letter signed by Nichole ** dated June 19 that says, "Your loan is not eligible for a modification because you did not provide us with the documents we requested." The letter did not say exactly which items were missing. For two and a half years we have given BofA everything they asked. Meanwhile, while Nichole's letters showed up at the house at 1:30, Elise ** (a new name) called my husband's office and said she is now our account relationship manager and our single point of contact for all matters related to our account. She is the fourth single point of contact we have had in the last year or so.
Ms. ** said she is committed to getting our situation resolved and to being able to offer us some kind of resolution to things. She told us she is going to email me her contact information and a list of what documents are still outstanding. She listed three items she needed. One document was given to BofA in April '12 and another in May '12. The third document isn't even available yet, even to us. As of that evening, everything was signed and faxed to the number she gave us. My husband made a follow up call but there was not an answer nor do we have her address.
I started my own website. When I find articles and stories that support my anger, I post it and somehow I feel better. All victims just want to get on with their lives but I seriously doubt if we can until the banks get someone in the White House they can manipulate and buy.

My mortgage company was withdrawn from my account twice in one month, resulting in multiple overage/short check charges on behalf of my bank and multiple vendors. Bank of America has refused to take responsibility and cover those charges, which exceed $425.00.

I'm trying to get caught up on my mortgage by sending extra money every month. If the extra amount I send does equal one full month's payment, they send it back even though I'm including notes asking them to please credit the difference towards the principal balance of my mortgage. Bank of America will not accept it. Therefore, they are not allowing me to get caught up on it. We only got behind because we were taken by a scam through "Amerihope Alliance" out of Florida. They said over the phone that they would definitely get us a lower mortgage payment. Of course, they did not put it in writing. Then they said, "We're not telling you not to make your payments, but you have to ask yourself this: why would they be willing to negotiate a lower interest rate or payment?" That was their scamming ways to get us into trouble. During the negotiating process, no payments were to be made. Now we are so far behind that it's going to take a miracle to get caught up. We need help and really bad. Bank of America is not working with us to lower our payment or interest rate and they won't even accept the extra money we're trying to send. I really hope someone, somewhere is willing to help us. I do not want to lose my home.

Since last September 2011, I have been attempting to achieve a loan modification through Bank of America and after nine months, I have not gotten off of dead zero. They have the worst Customer Relations Managers on the face of the earth and they train them well in not returning calls, how to create poor voice messages (especially if you really want to hear what they have to say in giving a boss's name and number). They do not follow through on their promises to call back when you do manage to get to talk to one of them and their managers are no better.
I have since written to the CEO and President of the Board twice now and included copies to the Treasury, HUD, Missouri Attorney General, Fannie Mae, Dept. of Justice and various political figures. All I am asking for is professional and fair dealings, but Bank of America is incapable of such actions. It is a shame that our government does nothing to bring such failed financial institutions to light and make them accountable for their actions.

They had excuses after excuses for denying me a HAMP modification! They need to be governed. I have spent 4 years trying to get a permanent modification. The experiences I have gone through probably emulate everyone else's and it is extremely exhausting to try and recap but I am fighting and will not give up!

I was told to go for a modified loan. I got numerous packets of their loan modification info & forms. They already had my loan and seemed to want to help lower my rate. I heard that if you got your rate lowered, your credit rating goes down because of the amount you were no longer paying. I decided to go for a regular refinance. I have great credit, not underwater. What happened? The loan officer gave me the cold shoulder. He told me what I needed to refinance. I came back and now he said I needed to jump through other hoops. I told him, "I don't think you want my business." He said, "It's not me, it's BOA." I walked away. I went to Sterling and they had no problem doing a refinance, and why would they, but the real question is, why wouldn't BOA refinance my loan? Something was not right. They were putting me off.
Today, June 22, I missed the news story about BOA & their loan modifications. All I know is that there's trouble. I googled up past stories that say they inflated house appraisals and gave out more sub-prime type loans. I heard the day before that many loan modified people were defaulting, with the news not saying if they were originating from any particular bank, but I can make a good guess as to who is the worst bank in the bunch.
I'm reading a lot of negative things about BOA's practices.

I've been waiting to hear about my application for a loan modification since February 2012. I sent documentation repeatedly as they would ask for an item or two at a time, instead of in an organized manner. The representatives have a robotic voicemail that states they will get back to you in one business day, they don't. The latest: "A decision has been made and we sent you the letter." I never received a letter. I asked repeatedly for a copy. The rep told me he'll see if he can "pull it up", read it to me and also send a copy. This doesn't work out. A callback by me two days later and all of a sudden, he said he can't release the info since he didn't send it, but he did put in a request to resend to the other department. Apparently, I am the first customer he has dealt with since he didn't know this policy the first time I spoke to him.
The bottom line is, I now can't even find out what the letter said! I did call the supposed principal of this rep whose voicemail also stated one day turnaround on the call. There wasn't, still haven't heard from him and have placed my second call to him and my first to the 3rd level boss. The third level guy at least does not promise a call in one day. Wow, unbelievable. If I did this with my teaching job that is regulated by the state, I/We would be all over the news. Where is the federal government? Is this not their program?

Bank of America's inability to keep on top of records: My husband and I were leaving on a trip, and my husband made sure we were up to date on our mortgage payment. Everything was taken care of through Bank of America. After being back for two days, someone stopped to ask if our house was for sale. It was unfortunate, because my son answered and talked to someone most likely from a realty company. Two days after that, 3 men (at different times) came to my door inquiring if my house was for sale. I cannot believe the ineptitude of the workers at Bank of America. It is not only alarming, but it raised my level of anxiety. It was totally unnecessary and was directly due to their incompetence at Bank of America. This bank is over the top, very heartless, and uncaring. My husband called the bank, and he got an "I'm sorry." That just doesn't seem to cut it for the anguish they caused me and my family.

I have been trying since February 2012 to refinance my current BOA mortgage. They currently hold my loan. Since 1978 I have owned homes with no issues - ever. Different people have told me different things about what to send in. I have submitted some of their requested paperwork two and three times and it gets lost. They closed and reopened it at least twice along the way. Today, I got a call from Julie that all was going forward. A few minutes later, she left a message that, oops, I now need to redo my $900.00 appraisal - for real. That’s not happening. Wells Fargo has a better rate and will now get my entire loan. Four months and BOA can't close a current customer's refinance!

My wife and I have been trying for 11 months now to get a loan modification through Bank of America after I lost my job and had to take a much lower paying one. We have hit a wall with them and seem to be getting nowhere. I handed in all the necessary forms and paperwork (months ago), sometimes 2 or 3 times, because they seemed to be misplaced. Since I have an FHA loan, I also went through the mandatory 3-month payment suspension (which has to be paid back in one lump some anyway) and now for the last 3 months, I keep getting told, once a week when I call, that my account is "waiting to be reviewed by an underwriter." Three months that my account has been just sitting there.
So during this time, we have fallen 2 months behind on our mortgage and Bank of America seems to show no interest in helping us, even though they know about our financial hardship through all the paperwork and the hardship letter we provided. Also, my primary contact through this entire process, who was always available to give me updates and answer my questions, I can now not get in contact with him (or his manager) for the last 3 weeks no matter how many voicemails I leave. It's frustrating because we even would consider refinancing or any other option to get a lower mortgage payment, yet Bank of America shows no interest in helping us with any of those options either.

After trying since November 2008 to get a loan modification and getting absolutely nowhere with BofA, we are now forced to do a short sale. My husband has MS and lost his job and we can't make the mortgage payments now. We haven't made any payments for 18 months because we just don’t have the money. Now we are forced to sell since we can't get a loan mod. We sent all the paperwork through our attorney to BofA and they came back saying a short sale would not be approved, and that the only way we could sell our house was by paying the full amount due on the loan. We are underwater and owe $60,000 more than the appraisal and have no way of coming up with the difference. They are not willing to work with us and ever program that I have tried with them is not possible for one reason or another, even though we certainly have a valid hardship.

I have been paying Bank of America my mortgage for at least 2 years. At first, they had taken $249 after telling me it was extra in my escrow. They took it. I complained to the Attorney General's office that virtually did nothing after 8 months of me faxing to them and allowed BofA to respond verbally instead of in writing. When it was in writing, it was lies.
The problem then became worse because then BofA started to keep large amounts of school taxes to the point that my prepaid taxes paid into my mortgage every month and with not one payment missing, my taxes disappeared. I pay $220 in my mortgage every month this year. Insurance was paid in May for $391. BofA started to charge me an extra $4 in January calling it an insurance increase. This was a lie and my whole year's worth gets paid in full in May and was paid in May 2012. Then my county and city taxes were paid $812 in full on March 1st. This was to leave at least $1,300 in my escrow to cover taxes for school due in August. My taxes that I have been paying including an $8.25 cushioning for 21 months never went into my escrow account. As a matter of fact, I also paid since May of 2011 an extra $14 a month to cover some after grace period fees.
Last month, my statement for Bank of America read -$38. Since I have no late's at all and all my payment have been made every month with none missing (which I can show), then there should have been at least $1,300 to $1,400 minimum in my escrow account. Bank of America has been billing me for taxes and keeping those taxes. I refinanced with another bank in fear of losing my home. At settlement, they were shocked to see the lousy number of refund response from Bank of America of $143 to be refunded instead of $1,400.
Also, Bank of America made me pay all of after grace period fees all over again because they never put one dime of the $14 increase per month from last May of 2011 to those fees (total of 12 months of $14). My school's taxes are what they stole. Taxes for West York Borough get paid in full every August. My escrow read -$38. I can prove I paid every mortgage payment and that my taxes are included. Also, taxes for my borough did not go up for 2011-2012 year so the cushion I also paid of $8.25 x 21 months should also be refunded. I had to pay approximately $4,500 or more to refinance because I knew with all the school taxes missing, they were going to illegally put me in foreclosure.
The gentleman who works in Bank of America in Lancaster, PA told me he is aware that Bank of America has put a lot of people in foreclosure who never should have been put in foreclosure. Last but not least, a check in the amount of $200 came today as a settlement reimbursement from Bank of America. I am taking copies. I also saved my complaint and correspondence to the Attorney General's Office.

I attempted to get a loan modification with Bank of America. All I wanted was a low-fixed rate and out of my ARM, so I went to a BofA customer outreach program and brought all my paperwork. I was there for 5 hours and left with a positive feeling after being told I qualified for the modification. The following Monday, I received a call stating I was approved and all that was needed was underwriting and an interest rate decided on and that I would receive something in the mail within two weeks.
That following Friday was when everything went downhill. I received a phone call from a woman named Rosie, who was my BofA contact. Every time I called BofA and put in my account number, I would be transferred to her. Three weeks later, I still had not received a modification, and when I would call my appointed contact, all I ever received was a voicemail that stated my calls would be returned within one business day.
Four months later and 20 calls later, only one was ever returned. I received a letter stating I was declined for my adjustment for reasons of my gross monthly income being too high and the bank adding $900 to my gross monthly income. I appealed the decision and provided more paycheck stubs and tax forms, and it was declined again for the same reason. The only person I can ever talk to was my appointed account manager Rosie, and she has no clue what was going on or why the calculations are so incorrect. It seems Bank of America has no interest in helping homeowners to keep their homes or assist them with any type of customer service whatsoever. I am still awaiting a return call from Rosie.

In late February, I went with my friend to Bank of America, seeking a loan under TARP to refinance my existing loan with them. My home's value has fallen below the balance of my mortgage, and all I wanted was a rate that would lower my monthly payments, so I could rent the place out when I retire in a couple of years. On a conference call with a Mr. James, all my information was reviewed; after which, he stated I qualified under the Making Homes Affordable Program for a 4% APR 30-year fixed rate from 6.25% I'm paying now.
After being told by Mr. James of BofA that I qualified for this loan in front of witnesses, he told me that I must pay a $400 upfront appraisal fee that would be refunded upon closing. Now why would there be an appraisal of a property when the issue and purpose of the refinance under TARP was the loss of value below the existing mortgage balance? Nonetheless, Mr. James assured us this was standard procedure and was necessary. He furthered we should not worry because I was already qualified. The closing date was set for 5/22/2012.
I waited patiently, and in the interim, I received several calls requesting copies of a document, which I complied with. My last discussion with Mr. James or his crony revealed "Don't worry, Ms. **. We are almost there!" Finally, two days before the closing date, I received a notice from BofA that my application had been rejected because "My application was incomplete!" I called the number and contact person listed on this letter, asking them to explain to me exactly what was missing from my application.
They have so far ignored the request. So, I have concluded that they never intended to refinance my home in the first place! Meanwhile, Bank of America has taken more taxpayer funds under TARP than any other bank. Not to mention, they have settled more lawsuits for predatory lending than any other bank! Bank of America should be banned from using America in their name and should be charged under RICO laws for their fraudulent practices!

The loan was paid off in October 2011. Nothing was received from BofA nor the Orange Country recorder's office as of June 2012. The copy of letter to us was sent in October and it was dated June 2012. BofA is stalling on providing a copy of document sent to recorder. They say it could take 30 to 60 days. Imagine if we took an extra 30 to 60 days to pay them.

We made an offer on a foreclosure owned by Bank of America. They have accepted our cash offer but have postponed the closing 3 times. With no notice, they do not give any indication when it is reasonably possible to close. I have had to waste 3 vacation days due to this. We want to know when we will close. They do not respond to our realtor.

This is a rental property; the lender is BOA and it is backed by FannieMae. I was looking for an in-house loan modification. I am paying a whopping 6.5% when new rates are less than 3%. Since this is not owner-occupied, it does not qualify for the HAMP, which is a Federal program. Bottom line is that BOA has no skin (risk) in this game. My financial situation is that I lost my credit rating because the banks were reckless in selling our mortgages on Wall Street for greed and profit. The scheme backfired and Main Street (consumers) bailed them out. BOA is still greedy, and will not help their own customers retain their property by just lowering the interest rate by 2% points. Stop doing business with these banksters, use your credit unions who are part of the community.

It has been 2 months since my buyer wrote an offer on a short sale home with Bank of America. Not only has it been 2 months and we still don't have an acceptance, but it has been 2 months and we are not getting anyone from the bank to email us or return phone calls to tell us where we are at with the offer. I can see it taking this long if there were multiple loans. But there is only one! The only news I have received in over two months is they were sending out for a new appraisal and that was 3 weeks ago.
The sad thing is if we don't hear by Friday, my buyer will walk and we have to start all over and find him a different house to write on. And on top of that, he will probably never refer me to other customers even though there was nothing I can do, but wait to hear from the other realtor who has the listing with Bank of America, who won't get back to her! Worst experience ever. The other banks all communicate with you during the process and for the most part, keep it rolling fast during the process.

I am a very angry Bank of America customer! I am a real estate investor and purchase properties frequently and presently hold two mortgages with BOA. I received a letter yesterday informing me that one of my loans is being transferred to a new servicer, Ocwen Loan Servicing, LLC. I investigated this company only to find out that they have only been in business less than twenty years. They have a plethora of complaints on the internet and to add insult to injury, the customer service person I spoke to was in India. With their name being Bank of America, have the temerity to sell my loan to a company that is a scammer company with negative ratings and that takes our jobs from us here in the USA.
It is obvious that BOA did no investigation on this company. But what does BOA care? They made their money on my loan by selling it to Ocwen. BOA is a foster child for "American greed". Yes, I was one of the tax-paying citizens that bailed their butt out of trouble and this is the gratitude they give their customers. I will never deal with Bank of America again.

I completed a loan modification one year ago. However, BOA has botched up their system and does not post my payments. They have no problem collecting the money and reporting late payments to the credit agencies. Attempts to correct this for the past year have been fruitless. No one at BOA bothers to return calls or correct the problem with their electronic systems. I am going to see an attorney tomorrow and file a lawsuit against them.

Sarah ** was a great representative who returned calls, made suggestions, and followed up. Now I have a new customer rep, who cannot be reached, nor his manager, nor the senior manager. Automated calls are the only way to call B of A and there is no response. This does not qualify as customer service as no one returns calls.

I forgot to pay it last month, so I called and spoke to three different agents to pay over the phone the current bill and last month's. They all told me they couldn't because the people that could help me were not open, but that I could send it in. I sent in $120 on Saturday and on Tuesday, I called, spoke with Gregory and he told me that he would get me to the dept that could help me and that as far as he could tell, any and all of the agents could have done a payment over the phone. He apologized and sent me to FIA, to explain what had happened about there being new people and misinformation.
I spoke with a female who told me I could call in on 5/31 and make the payment for $25 and to check on the status of the $120 check. When I called in today, I was told the account was in limbo and that no one could take a payment, that I could always mail one in and that there was virtually no way to let the company know that I was trying to make the payment. I guess I am supposed to help the mail service get the payment there before I get sent to a third party agency.
I am dissatisfied with all the misinformation and with the fact that we all know there are a lot of people who choose not to pay their debt and the fact that I am trying to pay my debt and there is no resource for me to get this issue resolved is wrong.

Wow, I can see that I am in good company here. Reading some of these complaints is like deja vu. Long story short, I needed a home loan and BOA was offering great rates. Not worth it. The BOA branch in my area referred me to the BOA mortgage processors in Texas. Initially, they were very attentive to my needs. I paid for an appraisal through BOA and the appraisal came back $30,000 under the asking price. The buyer surprisingly accepted the new offer, but that's when things started to go awry. Even though I have an excellent credit history, stable employment, etc., I was repeatedly asked to submit ever more ridiculous documents and proofs of my existence. I complied with all requests and had all documents submitted to BOA one week prior to the BOA deadline and two weeks prior to the seller's closing deadline.
After a week of not hearing from BOA, I emailed an inquiry about a closing date. I was informed by the underwriter that the loan application had been cancelled due to my noncompliance with requests. I was also informed that BOA had not received documents forwarded by my real estate agent and insurance agent. I was able to provide my loan officer at BOA with proof of successful transmission of all of the documents requested. We were able to get an extension for closing from the seller and I was under the impression we were back on track. My loan officer went on vacation for a five-day weekend. The next day, I was informed by the underwriter that I was short on funds to close on the home and the loan would not be reactivated. This was incorrect. I had three times the amount available to close on the home and had sent proofs of this on two separate occasions.
My loan officer was on vacation, but he left me contact info for his supervisor. The contact info was incorrect, but I was able to locate the correct information on a previous email. I emailed the supervisor and the underwriter, instructing them where they could find info about funds available for closing and offering to resend the info. I received no response. When the loan officer returned, I contacted him. He had been copied on all of the correspondence I had sent while he was gone, as well as correspondence from my real estate agent and the seller. Again, no response. I was just informed this afternoon that the seller has terminated the sale and after two months of trying to close on this home, I am back to square one. I am also out about $1,200 in appraisal and inspection fees. I must say, however, that judging from many of the other complaints here, I am relieved that I did not get a mortgage from BOA! After several attempts to sign correct loan documents, I verified by email with my Mortgage Loan Officer that the loan had closed and the final set of documents were correct. I was advised by email that the loan had funded and that the first payment was due on June 1st, 2012. Additionally, this same email informed me that I would receive a "Welcome Package about the middle of May." Since I have not yet received this package, I contacted the Bank of America call center. The associated noted above advised me that she and her supervisor had researched the issue, and since the loan documents reflect a first payment date of May 1st, that she could not assist me and the Mortgage Loan Officer would have to assist me. The last contact regarding this loan that I have had with a Bank of America associate, prior to this telephone conversation today, was the email that I received advising me of the June 1st due date.

Recently, my mom and I were served an eviction notice and were given ten days to leave. My mom had just got out the hospital. She is too sick now to move! It all started back in 2008 when she took out a loan to help pay for her growing medical bills. When she applied for a loan, the loan servicer never left any documents. Of course, this was from a big bank, whom I am sure people know about: B of A. She tried three different times to get a loan modification and they refused to help! I found about the foreclosure in the local paper. We were never notified of anything! Thanks to sloppy work in the part of the bank, the loan supervisor, the robo singing, and the misinformation and documents that do not have the same dates! She was also told to not make any payments and that there would be no sheriff’s sale.
On the day she was told there would be no sheriff’s sale, we were notified it was sold, right from under us! My mom is over 65 and she has several major medical problems, including MS, fibromyalgia, a brain tumor and spinal problems. We have been lied to and I feel she was taken advantage of because of her health and age. Why am I writing this? I am hoping to bring to light the greed of these big banks and the outright illegal ways they do things! Furthermore, I am trying to give a voice to those wounded vets that come home not only to lose an arm or a leg, but lose their homes, and older Americans that are taken advantage of, along with disabled people! This is pure greed! Plain and simple. I should know: my mom and I are victims of this! This needs to stop! I am sick of reading about people that have these loans and are forced to pay more than the actual value of their homes, or when the mortgage rates go up with no notification! We need change! Are they now too big to fail? Or are they just too big to care?
What really gets me is that the CEOs and bank executives get big paychecks while we have homeless veterans, people losing their jobs, malnourished children, and people who are forced to choose to make mortgage payments or put food on the table or pay for life sustaining meds. It’s quite obvious that these big banks do not care. All they want is their money. Who cares if someone has an illness or a wounded soldier defending our country? Yes, the people of these banks returns home to find out he or she has no home. My heart and prays go out to those folks. It stinks that these banks can do that. How can these people live with themselves? This is the result of being taken advantage of, lied to, robo singing, and the fact that she is over 65.

We fell behind on payments on a rental house because of a long term unemployment. BOA told us twice that they had a loan mod program/other programs for us. We sent in tons of paperwork as they asked and then said that we did not qualify based on it not being our primary residence. We signed up with a knowledgeable agent to get a short sale. They had the price too high for about a year and it took considerable negotiating to make them see their error. They sent out a new appraisal and made that part okay. We found a buyer who agreed to take the place with the tenants in it. BOA goofed off and kept sending out foreclosure notices and the tenants left. They left tens of thousands of dollars worth of damage to what had been a 100% remodeled home. The buyer walked because he did not want to fix it before re-renting.
The agent found another buyer who would take it as is and with all the same conditions. We signed all the paperwork to make this happen. Four days after telling my agent that the sale would wrap up in a short time, they foreclosed. The real twist is that they sold it to this same buyer for the same price using the same agent after the foreclosure. Just that my credit is ruined because of the whole thing. I have gone round and round with them about this. I have two letters from them that have conflicting and misleading information that is 100% contrary to the sales documents we signed. They have given me "contacts" to call that either never return my call or are never available. I have never met a company that treated a customer like this and managed to stay in business. I feel that I have a possible suit for breach of contract or similar things.

We financed our home with Taylor, Bean & Whitaker in July 2007 and did not once ever have a problem paying our house payment on the Web. There was no fee to pay it, nor did I ever have a problem getting the payment coupons should I want to mail in the payment. Then, in September of 2008, when the economy went to hell, I discovered that Bank of America would be required by the federal government to take my loan.
After several phone calls (none of which had the same answer), I was told to hold on to my payment until I received the mortgage documents from BofA. I was assured that my payment would not be considered late. As soon as I received the new mortgage documents, my husband and I paid the house payment, which was assessed a late fee because it was past the grace period for the month.
After many phone calls to no avail, we just accepted that we paid a $40 late fee for the month and moved on. By the way, they never bothered to send any payment coupons, so I had to pay on the Web ($6 fee), pay on the phone ($22 fee), or drag 3 small children to a branch and go in to make the payment because I do not have any accounts with them other than the mortgage.
In January, 2009, my husband's company was bought by another company and his pay schedule changed, effectively creating a hole for us at the beginning of the month when all of our bills are due. Both of us called BofA to ask if we could give them biweekly payments, which would end up giving them an extra month's mortgage at the end of the year, but would allow us some breathing room and keep all our bills current. We were told no, they do not accept partial payments and that our contract stated that their payments are due on the 1st and that is their policy in every case. That's not true, by the way, as I have a family member who has a mortgage with BofA and hers is due on the 15th. So, we have tried to pay by at least the end of the grace period to avoid any late fees, which can be trying.
In October, 2010 I needed urgent surgery and was out of work for 2 months. Even with disability insurance it was tough trying to make our house payment. We called Bank of Crooks, I mean America, and explained the situation and asked if we could skip a payment but tack it on to the end of the loan, if we could pay half, etc...anything they could to meet us halfway as we wanted to honor our obligation but just needed a little help. Sheila sent us to the retention dept, whereby Greg told us if we could come up with one month's payment, he could put us into a program that would help us with our payment due date, which sounded like a lot of confusing double talk to me, but what do I truly know about mortgage banking? So we dipped into our children's college funds, came up with the money, took it to the bank, and called them to see what program they could put us in. We were told that there is no program, all we did was stave off foreclosure for another month. (But we were only 2 months behind. )
I was at the point of just being ready to let the house go, but my parents came to our rescue and loaned us the money to get current with the mortgage. One week after we paid our past due amount, I received a FedEx package stating our house was going into foreclosure. Of course, calling received no answers from anyone. Finally after 2 days of leaving messages without receiving return calls, I actually got to speak with real person, who said she had no idea where those documents came from, because our house wasn't in foreclosure.
Mind you, EVERY single month I have had to pay a $40 late fee because they are unwilling to bend a little. I have tried to find another bank to do a refinance, but with being late, we have been turned down because there is a 30-day late showing on the credit report and you must be at least a year from any 30-day late payments to qualify. The other day, I went to a branch to make the payment for this month, and when I complained/explained our situation to the "personal account rep," she just shook her head in sympathy and said that the mortgage dept of the bank is notorious for this kind of behavior. Obviously, from reading all the posts on here! She also told me that "I could get fired for saying this, but I work here but I don't have my mortgage here." What does that say about this business? There has to be something that can be done. This is nothing but a racket.

BOA and Keep your Home CA - BOA says they honor it, but they aren’t. Why? "They have their own hardship fund/modification." Well, FedEx just sent me two letters to tell me the modification was denied and by mid June, expect foreclosure notification. Say what? Really? I have provided every piece of documentation they requested. I faxed them from a nearby BOA to theirs. I have the day, time, confirmation number, and person(s) faxed to. My income is our only income. My hub is still in review for SSI. His heart disease is excelling, and not in a positive way. We have older rescue dogs. We feed the poor homeless cats whose owners left them behind after their foreclosures.
I’ve contacted the BBB, Federal Reserve, Consumer Compliance, Atty. General, etc. I've had a three way conversation with my so-called rep from BOA (third one since Feb), a counselor from H.O.P.E the other day. Emma, the BOA rep said she’d have to have a couple of days to go through my paperwork. Really? You mean you send out denials before you even have the paperwork gathered and uploaded to your computer? When the counselor from H.O.P.E (Mallory) said the conversation would be taped, I'm like “absolutely!” the BOA re? “For quality purposes only, right?" Got something to hide? Uh, yeah. Anyone else wants to join my bandwagon. I'm not going to lose without a fight.

On Memorial weekend 2011, a tornado came through and took out the north end of our barn. We had some roof damage, trees down, windows broken and personal items lost in storm. Insurance company gave some money for windows, personal property loss of trees and to repair one side of 4-sided roof. My husband was able to use roof money to do the entire roof. We received one check in July for $28,000 made out to my husband, me and BAC Home Loans for the barn.
Barn was only covered for $30,000. Insurance had estimates to fix barn from $30,000 to $50,000.We went to Bank of America branch in our town and planned on getting caught up on back payments (2) and pay some ahead, then start doing clean up and fixing the barn ourselves. The insurance company told us that we could fix it, tear it down or do nothing. The Bank would not cash the check said that BAC Home Loans needed a Letter of Intent. That was given to them; they faxed over paperwork to fill out for a licensed contractor.
We were not going to have a licensed contractor do it because my husband was laid off work and would be more than capable of working on the barn himself with help from friends. They would not agree to this and would distribute money to contractor. We have been back and forth with the bank. Then on October 17th, I received a letter from a lawyer out of Detroit area saying that the house is in foreclosure. I ran the check to the bank that day and wrote another letter of intent to just put the money on the house that we would do anything with the barn. I needed to save the house. I faxed to BAC Home Loans the insurance estimates on Jan. 4th 2012.
On May 14th, I received a bill in the mail from my insurance co. that we needed to pay over $1,800 for insurance on the house. I called BAC Home Loans to see why and this is when I found out they sold the house on Dec. 2, 2011 to an "Investment group," I think that I got out of them, Bank of New York. I have not received anything about this. Michigan has a 6-month redemption period. It is up June 8th 2012. I talked to a lawyer on May 16, 2012. He pretty much would listen to my story and said that we need to find out what happened to the $28,000 check.
I went to my insurance co. and told them that I just found out that the house was sold on 12/8/11 and I needed to find out what happened to the $28,000. They got on the phone and found out that the check was cashed on Oct. 28th 2011. I fell apart in the insurance office. I can't believe that the check was cashed and the house was still sold. The insurance co. is waiting from the adjuster to find the check to see who cashed it. I went to the bank branch and asked for a payment history.
In July 2011, we were only 2 months behind and that was the last payment that we made with one of the insurance checks that we received. There is no record of the $28,000 on the payment history. Where is the money? The check was cashed; where is the money? We could have been all caught up and would have been able to pay more ahead if they would have cashed the $28,000 check in July and we would still have a roof over my family's head.
I tried contacting a couple of lawyers to see what we can do. Are they scared? They are just flabbergasted and don't say much and don't know what they can do. OJ Simpson got off and there is no lawyer that can see there is something wrong here besides me being behind on some payments, bad communication. I'm learning my mistakes. If I've got to leave my home, I need to at least get that $28,000 back to find someplace for my family to live since it isn't going to be used to fix the barn. Not that Bank of America is going to cry, but I'm pulling my accounts, personal and business, and going to find another bank.

We are having issues with our mortgage company, BofA. A year and a half ago, we started the home modification process on our house with BofA. Last April 2011, we signed the final documents on the modification. In July 2011, I noticed I could no longer make my mortgage payment online, so I contacted BofA. They told me that since I have an abnormal loan in the modification category that I was not allowed to make payments online, but that someone would work on the account to get this issue resolved so I could do in the future. I worked on this for months with no resolve. Then for some reason in the fall of 2011, our account got transferred to an account specialist manager named, Sonia **, in the office of the CEO and President. I made a phone payment in November and was promised I would not be charged a phone payment fee since I was not able to use the online payment feature. They charged me anyway and told me that they could reverse it, but they would have to stop payment on the whole mortgage payment and refund it to me and I would have to make another payment once the funds were returned to me. Not a $15 check returned to me or a credit on my account was offered for their mistake.
Then on December 14, 2011, I made another phone payment with a representative in which she accidentally charged me two mortgage payments and overdrew my checking account. Being that it was right before Christmas, I was forced to do a checking account advance through my bank to cover the funds that should not have been taken out of my account. I contacted BofA regarding the matter in which they told me that the only thing I could do was stop payment with my bank and then process another payment with BofA once the funds were back in my checking account. So that cost me $50 for the advance and $30 for the stop payment fee. I then proceeded to get my $80 that was rightfully mine from their mistake and did not get a check back from them until four months of harassing them. I have paid my mortgage on time every month.
Now this last month, I get a statement and letter from BofA stating that I owe $174.48 in late fees and that the payments I have been making since January 2012 have not been applied to my mortgage but are being considered as a partial payment. So now, I am worried about my credit score! To top it all off, no one from the company will talk to me accept my account manager who can’t answer my questions when I get a hold of her or return my calls. So after weeks of escalating calls, I finally get a hold of the VP of BofA who assures me her assistant will take care of this. It has now been days of leaving professional and courteous messages and the VP won’t even return my calls.

I borrowed $31000 home equity line of credit mortgage from Country Wide Bank in June 2003 and then I refinanced that mortgage from Irwin Bank in April 2005. But in 2007-2008, Bank of America took over Country Wide Mortgages. Now in 2012, I want to refinance first mortgage that I have currently with BOA from some other bank but my title company cannot issue new title since on my credit report it shows that BOA is still holding lien on my home equity line of credit even though it shows paid and zero balance on my credit report.
My title company has requested BOA to release this lien, but they have not gotten any response from BOA even after a month. So I got involved and called a couple of times to their customer service and every time, they opened a new ticket and keep telling me that they're still investigating this issue and don't have much information. It's been three weeks now since I got involved but no luck in getting lien release. I have provided copy of the original home equity line of credit mortgage contract that was signed with Country Wide Bank in June 2003 and also a copy of my credit report that shows BOA is holding lien for that account even then. What's taking so long?
Because of this I'll end up paying more on my refinance now. This is the ridiculous customer service I have gotten from one of the biggest banks in America. This is the reason I'm going to stop doing business with this bank.

In June 2008, my husband lost his job. I contacted BOA for a modification and I was told "do not make your mortgage payments until the modification is approved and finalized". I clarified several times as I thought that was very odd. They modified with a lien at 0% on my house. That did not help since we had a loss of income. In Nov 2008, I requested a payment reduction and meanwhile, I was paying a portion of my payment weekly that apparently was not applied to my loan. I worked with Nikita and reduced my payment a couple hundred dollars, signed that made payments for 10 months and meanwhile, receiving new modification docs every few days. The month of June, Nikita would never return my calls so I talked to a manager who said to ignore them and they were just backlogged.
In Oct 2009, after paying the agreed modification amount, I received a letter that they were going to foreclose. I immediately called BOA to find out why. I was told the modification didn't go through because of a lien on my property. I took 8 weeks for them to understand the only lien was BOA. I requested manager after manager and promised call backs and was told I would have to reapply for a modification. After fighting that, I was slowly finagled into reapplying and was told I didn't qualify because since I got a second job to fix my arrearage, I made too much money. WTH. So I'm a hardworking citizen trying to make things right. Then on Dec. 28, Nikita called and said they made a mistake and to sign these new docs which was $50 more. It wasn't the money, it was that they were identical to the one I already signed and paid on. I had to return them by Jan. 1.
I asked how this protects me as they are the same. How can I know I won't pay for another 10 months and I get a new notice that they are foreclosing? Her response, "we can't do that". What? They did just that. Without having time to review with a lawyer, I decided to just walk away as I owe $260k and 2 houses down just sold for $54k. Then I received a request for all the documentation to apply for a mod. They just told me I don't qualify. They take advantage of people that are helpless and confused. They are liars and thieves. The government really needs to step in and oversee these operations. I was penalized for working 2 jobs to make sure this doesn't happen again. I was willing to pay the $1,700 payment for the next 27 years, but they chose to take it as a loss for about $30k. After all, costs are involved because their tax break is probably more profitable or the reps of the phones are following a flow and can't think outside the box.
I am now going to walk away from this piece of crap house with plumbing, energy, termite and roof leaks to rent a house for far less than what I would have to pay them and no worries in my head. I will never ever deal with BOA again. After reading all the similar scenarios where they tell you don't pay, oh yeah. I got a refund check for my modification payment on 2/28 and a day later, that my short pay was applied to the balance due. WTH BOA, get it together and figure out what the left hand is doing. A bunch of ** with no common sense. Really? I was willing and able to pay them the $1,700 a month for the next 27 years, but they're opting for foreclosure which will make them $30k at most. Oh yeah, my last statement said my loan term was like 24 years. I have a 30 year from 2007. They're clueless of what's owed and the courts should not allow them to foreclose without the original note. Banks are crooks.
My mortgage was sold to the same company that wouldn't refinance me before my first payment was even due. Go figure. BOA should be incarcerated for fraud. All these CEO that rip people off, make all the money while the employees do all the work and take pay cuts, and the mortgage companies refuse to take partial payments even though over that month, it is the full amount or more or they charge you to make bi-weekly payments. Total crooks. I had BOA for my checking too and I transferred money at 10:30PM, which was no longer available in that account but it didn't process until the next day because it was past the cutoff and I was charged $70 in overdraft fees for overdrawing less than $30. It's all a scam. Keep your money in your mattress!

I am writing this letter to explain the unfortunate set of circumstances that are presented upon me and my family. I am trying everything in my power to make ends meet and my goal is to keep the home; however, financially, things are just not the same and I am facing financial hardship situation.
I've been trying to go through a modification process with Bank of America. However, Bank of America is not willing to work with me due to their explanation that my mortgage is held by privately owned bank (which is Kearny Federal Savings Bank) and that Kearny Federal Savings Bank is not budging to modify my loan. As per their response, they do not have any programs that I qualify for, because my mortgage is not Fannie Mae or Freddie Mac. However, I called Kearny Federal Savings Bank and they have no opposition to modifying my loan.
I even searched for other banks to refinance to get a lower interest rate but no bank would refinance my property because I owe on it more than its worth. It's such a disgrace for Bank of America to treat people this way! The only reason I owe much more money on my property is because within 7 years that we've purchased this property, Countrywide (at that time) and Bank of America made me refinance twice on this property and only my closing cost for both times was about $20K. Now, I found out that my mortgage was sold (without my knowledge) to privately owned bank (Kearny Federal). Why wasn't it sold to Fannie Mae or Freddie Mac?
Other mortgage companies are telling me to put down at least $30,000 to lower my loan, and then I might qualify for refinancing at a lower rate. Unfortunately, I do not have such funds. I was planning to hire a lawyer, however they are asking for $3,000 or more for their services which I'm not able to afford.
On 08/2009, I turned to NACA for help, since their services are free and they promised to help me. On Dec 22, 2009, NACA submitted a proposal to Bank of America for a rate reduction from 6.75% to 4.00% for the life of the loan, but it was declined. After I drove to Washington and joined the Save the Dream event, Bank of America counter offered the rate deduction of 4% for 18 months only, which was $400 of savings on a monthly basis. At that time, I was so desperate and accepted the offer. I was able to pay my mortgage and never missed a payment since then. However, the 18-month deal is over now and the payment is increased from $1,800 to $2,200, back to 6.75% as of June 1st, 2012.
I've tried calling Bank of America and realized that neither modification department nor advocacy department are willing to help me. Meanwhile, on their website they are offering assistance if somebody is having a Financial Hardship and qualify for all their regulations. I will not give up fighting with Bank of America until they reach a fair agreement and will be willing to work with people as myself who are having financial hardship.

Back in 2005, my wife and I bought a small 2-bedroom, 1-bathroom home (800 sq. ft.) right after we got married. A little more than a year later, my wife gave birth to twins, and we did not have room for a family of 4. The housing market started to crash at this time, so we could not sell our home because the mortgage was more than the value of the house. Due to this, we moved out of the house and into a larger house. We rented out the small house, but were losing $800 per month on the house.
Since that time, my wife and I have asked for a loan mod, principal reduction, etc., but Bank of America said they could not help us until we missed a payment. They told us that once we missed a payment, we could get a modification. Taking this advice, my wife and I missed a payment and then tried talking to Bank of America. They told us that we did not qualify for a modification because we missed payments and because we made enough money to pay the monthly payment. We were then instructed to do a short sale. Eight months ago, we started the short sale process and then yesterday, Bank of America denied our short sale request because we can afford the payments.
The next step would be a foreclosure, but I can't do that because come September, I will get hit my Capital Gains Tax on the house because I am no longer considered the primary residence (must have lived in the house for 2 of the previous 5 years to avoid the capital gains tax). The reason we started the short sale process was to beat this deadline, but now we can't. Bank of America has assured my family of financial struggles for the rest of my family's lives. Bank of America could have done what was best for them and us, but instead wanted to stick it to us. Bank of America is truly the worst, and I honestly believe they are linked to our government, and together they are bleeding Americans of all of their money. It is sad to think that Americans no longer help Americans.
In addition, these banks are the reasons why house prices inflated to begin with. As usual, the bottom man on the totem pole gets it. We were lied to over the past several years, and now I am stuck. Thanks, worthless B of A.

BofA Home Loan, Walnut Creek, CA: Very poor service. I don't know if I expect so much from the team at Bank of America, but I'm very disappointed and upset because an easy conventional loan takes so long to process. Mr. James ** offered me a great service at the beginning of this long process and I think he is very capable and knowledgeable, but he left all the work to his employees without his supervision. It is very frustrating to work with people that ignore your emails and promise to do everything to get your loan funded by this specific date, but not doing nothing to make it happen. I sent all the information requested from BofA and I don't receive a respond until one day later. I wish I knew this before I started to work with BofA on my loan for my first house. I hope this review helps to improve your service and accelerate the process of your loans. Thank you.

I am trying to get a loan modification as I have been making my payments on time since BOA took over from Countrywide. I was told this process would take 30 days to 6 months to complete. I was also told that an escrow account would be created. Well I have not been officially told that my loan has been modified, however, they have created an escrow account for me and sent me a bill stating that I need to pay $1,900 into the account and then raised my house payment $343 monthly. I have called and complained. So far, no response and I cannot make these payments as I was long term unemployed, now I am underemployed.

I am at a loss of words in regard to BOA. I simply cannot believe what this bank is doing to people in United States of America! I have been trying to get a loan mod for my home since 2010. Now, almost 2 years later, nothing has been accomplished. They lie, deceive, ignore you and generally don't care. I cannot even remember how many times I sent and/or faxed them the docs they requested and they always didn't receive something. Just this February of 2012, I got FedEx letter from BOA where they requested some docs from me (I sent them all these docs at least 10 times already since this process began). After I faxed all the docs they requested from me, I called them multiple times and left multiple messages where I simply wanted a confirmation that they received the docs. I don't even know how many times I called, but I could never get anyone on the phone. So I faxed them all the docs 2 more times. Each fax sent was confirmed successfully. I have also sent them all files requested in the FedEx envelope provided.
Then a month later, I got another FedEx package from BOA where they wanted pretty much all the same docs again. Again, I faxed all the docs multiple times to the fax number they provided. I called multiple times to simply confirm they received the docs. I could only reach their voicemail. Now last week, I finally got a call from one of the reps at BOA and she was telling me that she needed some docs from me that they requested and I "never" sent to them. After a couple of minutes of back and forth, she finally found 1 then 2 and 3 docs I faxed them. She still was missing few docs and asked me to send it to them. I faxed everything again. She said she would call to confirm she got the fax. Yeah, right. No call from her and repeated calls from me only get me to her and all the other numbers I can get following her voicemail chain, voicemail. Unbelievable!

BOA bought my mortgage from Taylor Bean and Whitaker and has took our dream of owning a home and turned it into a real life nightmare. We have been fighting for the last 2 years to keep our home and used tax returns to bring our mortgage back to current due to my husband's job. So we are behind and tried to get a modification only to find we qualify for nothing because we have excess debt. So I have made many calls only to somehow end back up at someone from BOA telling me, "sorry, nothing we can do to help". I got a call suggesting to do a short sale and I felt as if it was being pushed on me. If we did not want our home, why would we be trying to save it?
People at BOA are normally rude and very cocky. I don't enjoy being talked down to like I am child and that's even if you get a person, half the time you get voicemails, put on hold or hung up on. After the call, I got a letter telling me they want x amount of dollars by June 6th or they will take it to the next step. All they have to do is work with us to keep us in our homes but instead, they rather foreclose and have the homes sit here empty and more than likely, be stripped from the inside out. What a choice. If I would have known I would be going through all this when we decided to buy a home, I would have kept throwing my money away on rent. If we are so willing to help other countries, why not help our own?

BofA is the worst bank ever. This bank should've folded years ago for the poor customer service, lack of communication between the reps, and lack of knowledge of the business. My husband lost his job almost 3 years ago, and shortly after that, we defaulted on the mortgage payments. We put our house up for short sale. A month later, a buyer was willing to buy our house. We postponed the closing date 5 times, and waited 5 months for BofA to decide what they wanted to do. At month 5, we all thought the deal would happen. So we moved to a rental home 1 week before closing to give me some extra days to clean up the house before closing.
Then 3 days before settlement day, BofA called and refused to take the deal. At that point, I had already moved, signed a 2-year rental contract. On the other hand, my house had been sitting empty for 2 years since then. I was beyond furious at BofA! During the 2 years, I applied for modification and was declined twice. I applied for Deed in Lieu and was told that I had to pay $15,000 to BofA for that to be approved. Now, the Department of Justice and state general-attorneys are asking banks to work out modifications for troubled homeowners. I received a letter from them, asking me to meet with a mortgage consultant at a local branch to discuss my options. So I did in April and gave them my paperwork. Three weeks later, I received a letter from BofA approving the modification, reducing my principal by about half and lowering my interest rate from 6.875% to 6% (big deal since the rate out there now averages 3% or so!).
Here is the catch, I don't know how the hell they calculated my monthly payment, but it came out to 42.5% of my gross income and over 50% of my net pay. I've been calling them, and of course, I never got through to a person. I waited a day for them to call me back. Then, when I told them about the ridiculous monthly payment they calculated and asked them how they came up with that number, of course, I couldn't get an answer. Besides they showed no interest in reviewing and verifying what I told them; they just basically told me that "It is what it is" and told me that I must make my 1st trial payment by 6/1/12, because if I don't, then it would mean that I decline on the offer. Then the next day, I spoke to a manager and found out that they calculated my income incorrectly. I asked them to rework the numbers.
They then told me that they couldn't guarantee that it would change anything. I told them that there's no way I could afford the payment they worked out, since it's only $355 less than my original mortgage payment a month. Common sense, if I could make this new payment now, then why the hell would I default on my original mortgage at the first place since the difference was only $355? I asked BofA why after the modification, the debt ratio is over 42% of my gross. I thought it was not supposed to be more than 31% of gross income. What she told me made me laugh in disgust. She said that's not true about the 31%. She said if my original mortgage is over 31% of my monthly gross income, then I would qualify for a modification.
So explain this to me that if that's the case and you modify my mortgage because my original mortgage is over 31% of my income and yet, you approved me a modification with monthly payments way over 31% of my income, wouldn't that throw me back to the same qualifications to apply for a modification again? I mean, BofA grants modification to fix the debt ratio, right? So what's the point when they still give you a modification like this? I think this is what they're doing. The DOJ and state attorneys are putting pressure on them to reach out to homeowners to help them save their home, but BofA really doesn't want to do that. So to satisfy the government, they pretend they're doing us a favor by approving modifications but with payments we can't afford and don't make sense. And BofA knows that we will not be able to take the modifications.
So now, they can turn to the government and say that they've done what they were asked to do but that the homeowners are not complying and declining the modifications. So now, it's the homeowners' fault. Then BofA will ask the government to compensate their loss in the mortgages they tried to modify. I wish the DOJ and state attorneys know what BofA is really doing to homeowners. They just play us and use us to get more bail-out money from the government. What the government needs to do is to close down BofA for good!

Taylor Bean & Whitaker serviced my loan until Summer of 2009. They gave me a 3-month forbearance and after the 3 months, I signed a 24-month repayment agreement ($139/month over and above mortgage payment). Within a month or two of the repayment agreement, Bank of America took over the loan. I thought everything was fine and continued making payments as agreed. By October of 2010, I received a notice that I was $1,900 overpaid in escrow. I called to find out when I would receive a refund, but was told I was in default so I would not receive the money. Since finding out about the overpaid escrow, I realized Bank of America (BofA) was obviously not aware of the forbearance and repayment agreement and thus to date, I have not been able to get them to honor the money I've paid back (now fully paid) or work out any solution at all.
Whenever I spoke to a customer service rep, they told me they either were not aware of the repayment agreement, did not have to honor it or I had to redo the agreement using one of their modification products. They have tried to get me to do loan modifications (which I am not happy about since I feel I already paid my debt in full). Despite my resistance to a loan modification, I did try to get one on three separate occasions since they threatened to foreclose last Fall 2011. Each time, I ran into a brick wall (never received paperwork, told I didn't qualify, told the offer was off the table and I was declined because I missed a deadline). This has been going on since November of 2010 and after a final review with Carl ** of the President/CEO office, I have been told they will not help to bring me current (this decision came on the heels of another guy in same offices that told me they screwed up and would bring me current).
Carl **'s rejection letter reason was they honored the forbearance agreement from the beginning, but I failed to make correct payments when my escrow increased in Jan 2010. It confuses me that the escrow increase was only three months after they notified me I had a $1,900 overpayment, so this makes no sense. I feel it is unreasonable of them to jerk me around and threaten to foreclose when all monthly payments and repayments have been made. It is unreasonable to dangle loan modifications as a way to correct the situation when they are unable or unwilling to even manage that process to fulfillment. It is a lose-lose for me, the loan holder, and very sad that even though I have made every payment to them, they can still conceivably foreclose on my home.

Payment posting error leads to foreclosure: Ever since my loan was sold to Bank of America, I have had nothing but heartaches. I must affirm that I have not once made a late payment in the two years I have owned this home. Their collection department continuously calls me at work (up to three times in one day), and it's always a different employee. I demanded they stop calling, but they don't.
I explained the situation and submitted it in writing, and nothing. The last incidence occurred this week. I composed a letter and attached this year's cancelled checks to show them their error, since they have begun sending letters of foreclosure and a certified letter as well. I cannot afford an attorney, so I guess they will foreclose on the house, since there is no way of communicating with someone who can correct the problem.

We have tried numerous times to get a loan modification. BOA contacted us in December 2010 that we had been pre-approved for a loan modification. This modification said we needed to make three on time payments, after which we would be contacted and put in a final modification. We made the payments. We were contacted by BOA by a letter stating that there were loan documents that were going to be sent to us. We finally received the documents, but we only had two days to respond. We told BOA that we wanted our attorney to look at the final documents. They said fine, but we could never get this to exceed the offer in writing, as the documents said we only had two days. One of the terms of the loan was after three years of on time payment, they would reduce the loan in the amount of $79,000, which was huge to us as we are upside down on the mortgage. As of today, we have been on this roller coaster of a ride with BOA. No new documents, no nothing. Just false promises of helping us. It is crazy. Stop the madness...

I don't know where to complain and just found this website. My husband and I were existing Bank of America customers. We had a 30-year fixed interest mortgage with them at 5.75%. We have excellent credit and have never paid late. We have no debt other than the mortgage. I heard the rates were low and decided to check it out last September of 2011. We were locked in quickly for 90 days at a good rate and were going to refi into a 20-year loan. This was my only purpose to refinance...to save some money and years! That's it!
We were great long term BofA customers. It seemed like it should have been easy, but it was not. We faxed over 400 pages of documents to them. Many times they were lost or claimed no one got them. We had to resend several things up to four times! They harassed us about my husband's nationality. He is a permanent resident with a green card for 20 years! He works full time and pays taxes here! We had to get the Swedish Embassy to handle this situation (and again, we are existing customers but now this was suddenly an issue). We were harassed about the $30 on a Kohl's card even though it was charged one month and paid off the next (Christmas gift). Same thing with a $60 Banana Republic card. We were told we didn't have enough sitting in our savings to close (even though we showed them $25,000 in our savings, which was the amount asked). It was one thing after the next month after month. Someone went on vacation and then our file got transferred to someone else. Left hand never seemed to know what the right hand was doing.
I spoke with a manager who promised to follow our case through to the end, and she turned out no better than the rest. The Charlotte office is a mess. I was the one driving this entire process along for five months. (Yes, they gave us two extensions because they could not get their act together.) We are in NY and we requested that they remove the CEMA tax (it's a NY thing). Promises, promises...this also fell through. They said yes for two months before they even started this process (and it fell apart too). They asked us to pay off a car (only $3K) and I did it same day. It seemed as if they were trying to think of things to turn us away. It really did feel this way. They stood to lose a little money and we were to gain a little money by doing the refi. They were most unhelpful.
I called and emailed at least weekly if not more. I was very quick to give everything they asked. This was a HUGE trial of patience. Sometimes they would not return my calls or emails for a week or more and sometimes not at all, but I was persistent and would keep calling! Finally, after five months, they told me I would need to give them $25,000 up front for closing and that they also had to extend my loan to a 25-year instead of a 20. Um, hello, we only had 26 years left on our current 30-year loan. This is what finally caused me to say, "Enough! No, thank you, BofA!"
At that time, I started researching on my own. This just seemed crazy that someone would not want our business. We have excellent (almost 800 credit scores each) and no debt. I quickly found another bank who did want our business. From start to finish, the process was under 30 days! I closed yesterday on my refi with a new bank. The process was so easy! Also, I qualified for the HARP program and this is something that BofA never told me! I did not have to give a dime at closing and no PMI. Yes, BofA said we would have PMI too with the refi due to the economy crashing and the house losing much of its equity. We are not underwater though by the way. So, no money up front, no PMI. I actually called my mortgage person at BofA to ask why he never told me about HARP. He said, "Oh, you don't qualify for HARP." I said, "Really? That is not what my new bank told me." He checked and said, "Oh, yes. I am sorry you do qualify. Would you like us to help you with that?" (Five months into it, no thanks!) Bye bye, Bank of America!

I am so sick of BOA! They are some thieves and corporate scam artist. I had an issue with customer service taking my payment as the idiots were typing in the incorrect checking account information. So they tried to smooth everything over claim that they were giving us a special account manager, which is a crock of **! I called the "account manager" and guess what, it goes to voice mail. I called every day and no call back. Mind you, I was trying to pay on my mortgage so I had to play around like I had no account just to get somebody on the phone. I am so sick of their mess! This has to be the worst bank ever aside from PNC. It's a corrupt little corporation.

Unfair discriminatory mortgage modifications - Now we see them doing it again, giving money to everyone except government's so-called backed loans Freddie Mae and Mac and FHA/VA loans. Since when didn't we all deserve a principal reduction? My home is valued at $144,000 and I owe $265,000, go figure. I lost $3,500 a month in income permanently four years ago. I'm still fighting for my house though! I am going to keep on fighting. I just sent BOA a RESPA.

We are premier customer, fast track qualified for a refinance. We started the process in January of this year and still cannot seem to close the request. Every excuse possible, asked same questions over and over, phone calls were not returned and left hanging without any information. I have been a customer for many years and am ready to cancel request; close our accounts and find someone willing to work with us. Very unhappy with the service and personnel.

Loan was paid off on 4/18 through title co. I've been given 3 different stories about when they will send the refund. They say 10 days after payoff, the day after payoff, ten days to start the "process" of issuing the check and up to 10 more days to actually mail it, but 14 more days before reissuing it, which is another 10 days more. How much money does Bank of America earn off us while keeping our money? It sounds like a scam. They say whatever to get you off the phone and do nothing? Who regulates when they have to send out refunds?

I’m trying to modify a mortgage, due to loss of a job in the family. Bank of America has made it a nightmare. They do not return calls. They put nothing in writing that they discuss with you about not making payments for 3 months (forbearance) and then continue to make payments until the modification is completed. In the meantime, you keep receiving foreclosure notices that you are told to "ignore" and that "everything is fine".
The last straw occurred when my husband tried to make the regular payment at a local branch of BOA before the payment was due, and was told that the account was "locked" and they could not accept the payment. We called Monica ** at BOA and was told she had to "unlock" the account before the payment could be accepted. We were told in the beginning that once you start the modification process, that you can't be late on any payments. Ms. ** assured us that she would unlock it and call to advise us.
That was 10 days ago. We still can’t make a payment and can’t get a return phone call. (As always!) And now, we have received notice that we are in foreclosure, even though we were assured we were still going through modification. We can get no info from anyone at BOA. They will put nothing in writing to you about your modification or the procedures regarding the same. It is my opinion that they are intentionally forcing you into foreclosure by their business practices.

I started the modification process back in November 2011. Today is May 8, and I am starting all over again. It is a joke, according to my first loan service manager (Shaheb). I submitted all of the documents needed, and now, we just wait. Then he literally disappeared, and someone else sent me a letter to say they were my new service manager (Susan). Susan told me that I was denied the modification in January, because all of my paperwork was not submitted.
Today, I am waiting for another packet from her in order to apply again. I have been off work for nearly a year due to illness, and I am 4 months behind in payments. So I got this letter offering me $3k to hand Bank of America the keys to my house I have lived in for twelve years. Next week, I return to work and will receive my regular pay as opposed to fifty percent of it, which is what I have been living off. My doctor has warned me that if I don't stop stressing, I'm going to have a heart attack and die!
Shame on Bank of America for treating their customers like crap. They don't deserve to be called the Bank of America. It's a disgrace to Americans.

Due to unemployment, our mortgage has been up to 29 days late one time. I have informed BofA over the phone and via the website of my intent to pay. I have received phone calls on a weekly basis and sometimes up to three a day from rude individuals claiming to be from BofA; they were asking for personal info and refusing to inform me of what the call is about. Even when my mortgage is up to date, I get these phone calls. I have called BofA to report these phone calls and they tell me that if my payment is not made on the first, they have the right to call me. If my payment was late, I would understand a phone call to discuss an issue; but I refuse to provide personal information over the phone to some stranger who claims to be from a specific company.

I refinanced my mortgage with Bank of America and the loan was paid on March 28, 2012. This was confirmed by Bank of America when I called them. My broker told me that I should get the balance on my escrow account within 20 days. I waited. Twenty days passed and I have not received a check from Bank of America so I called. They told me that their system did not somehow alerted them that a check has to be requested for the balance on my escrow account. So that day, the lady contacted the department that handles that. I can hear both of them talking about it. After that conversation, she told me the check has been requested and she apologized.
Almost two weeks later, no check came in. So I called again just to be told that I should wait 7-10 business days and if it hasn't come in, that I call again. I was frustrated but accepted it. Ten business days later, no check came in so I called again. This time the rep called the department that handles those check requests and he put her on the line with me. She told me then that they put a stop payment on the check because they made a mistake. The check was written for someone else. So I asked, “How could that happen?" She said she doesn't know. This call was last Monday, 4/30. She told me that she will send another check request, but this time it will be overnighted due to the delay and issues that arose, and that I should get the check Thursday, the latest Friday.
It's now Saturday 5/5 and the check has not shown up. What is wrong with Bank of America? They are holding up my money. The loan has been paid off over a month ago. I am so mad at them. I tried to call today and even though on their website it says they are open on Saturdays for mortgage-related calls, their system said they are closed. What a nightmare! They messed up with my mortgage payments in the past and that is why I was so eager to refinance my house so I can leave BOA. And finally I did. I thought the nightmare is over. Boy was I wrong! I don't know what else to do to get my money back from them other than call them.

I made an offer on a house MLS# ** of $169,000 on the house listed at $189,900 in late December. This was accepted (pending short sale approval) with a closing date of no later than March 30, 2012. Shortly (and conveniently) after the expiration date of the offer, your "bank" (I use the word loosely) came back with a counter of $192,000 (according to the listing agent). This seems kind of fraudulent since the listing is still online for $189,900. Please explain!

We co-signed a loan for our daughter in 2010, and we recently went to obtain a loan and was turned down because BAC has us with having delinquent payments. We had this straightened out back in August 2011 and had a signed letter stating this. We again went for a loan a month ago and was turned down as BAC never cleared our credit reports, even though we had a letter stating this was done. We now are providing proof that there was no delinquent payments. How can a huge bank like this do this to hard-working people. We have never been late and always had a credit score of over 800. When it is their error, why are we being the ones to prove our innocence? I really don't understand how a bank can let things get to this point and not clear things up when they said they would.

I heard of the new government assistance plan that would help lower mortgage payments based on home value/salary. I contacted Bank of America directly to see if I qualified for this plan and Nekita ** took my application and became my loan manager, and began a loan modification process. Throughout the entire process, I called Ms. ** every few days or once a week. She never called me when she said she would and every time I called her, she said she would call me back once she had an update. The number she told me she would call me on wasn't the correct number. The first couple of times she did this, I just figured it was a mistake. But every single time I called her, she would give me the same wrong number over and over again and at that time, I became unhappy with that situation. I still didn't contact her manager, but informed my family and friends of what a bad experience I was having with the loan manager I was assigned.
I finally contacted the manager's number that was on Ms. ** voicemail and couldn't reach the manager either (Melissa **). I began this process in November and asked Ms. ** how long the process usually takes. I was told on average, it takes 7 days to get a decision and at this point, it was January. Ms. ** was not properly educated on the new loan modification process because she had a hard time answering my questions. Finally, in March after I called Ms. ** several times, I was told I was approved and I was very happy. The reason I was happy was because the loan modification said based on your income, your payments can be lowered almost $800. Now this was based on the website, nothing that Ms. ** said to me. I just want to make that clear. According to Ms. **, my payments would still be over $2,000 a month and that was about $150 savings.
I asked Ms. ** if this process would affect my credit because I was told that it can. Ms. ** was not able to answer that question and so I advised her I would call back because I wanted to check with a lawyer first. The lawyer said it will affect my credit and how it would report to the bureaus, so I decided for the low amount of savings I would decline. I wanted to give a clear background of the situation before I state my problem. I contacted Ms. ** to make a payment every month and when I couldn't reach her, I spoke with an agent at Bank of America to make a payment. I normally would pay online after I set up online account because it was easier. However, when I tried to make a payment online, after I first applied for the loan modification, I wasn't able to because according to everyone I spoke to, you cannot make payments online during a modification process.
In March, I contacted Ms. ** to make a payment and believed it was processed. In the end of March and the beginning of April, I called back several times to ask to have the restriction lifted off the account so I can please make a payment online for April. Ms. ** said she would have it done and should be lifted in a few days. So I waited a week and still nothing. I called back and Ms. ** said she put in another request and again, nothing done. I called back and Ms. ** said she would take the April payment for me by phone but since I had a lack of trust in her, I was afraid that she would put the wrong date and felt more comfortable setting up the payment myself online. Since I called her far in advance to needing to make the payment, I decided to wait for the payment restriction to be lifted.
Finally, the restriction was lifted and I noticed it said that I missed my March payment, so I immediately called Bank of America and the agent who answered confirmed that a payment was missing. I searched my bank records and found that no payment had come out. I called Ms. ** and she did not answer, so I left a message. I contacted a manager in customer service by the name of Adam, or at least at the time that was the name he gave me. I explained to him the situation and that for whatever reason, the payment didn't post and would really appreciate some kind of courtesy because it was an honest error on behalf of Ms. ** or the systems for it not posting. Well, that is where all the problems began and I finally understood what all the people were telling me about how much they hated Bank of America and constant problems and poor customer service.
Adam was so very rude to me and talked down to me and treated me like I constantly paid my bills late and the worst part is that he lied to me. He scheduled a payment for me and when I asked him if my payment would be considered late or if I would be reported to credit bureau, he lied to me and said neither would happen. The reason that this wouldn't happen is because during the loan modification process, payments were not considered late. I later spoke to another rep the next day who said he lied to me and that I was charged a late fee and was reported. The agent confirmed to me the same that Ms. ** said, that payments are not considered late during modification process even if they were made late. That agent transferred me to collections department where I spoke to a woman who said she would transfer me to a department that would help me, but she hung up on me.
When I called back to find out her name, there was apparently no notes that I spoke with her. I contacted Melissa **, Nekita **'s manager, to express to her my concerns with how Ms. ** had treated me after the fact and how she was disrespectful. Ms. ** said that she would address that with Ms. **, but declined giving me a grace period to make my April payment even though she works in retention and I had never had any late or missed payments before. I was lied to by several agents at Bank of America and I have proof of the amount of times I have contacted Bank of America and Ms. **. I also have proof supporting the fact that I did not know that my March payment wasn't received because my April statement shows no past due or carry-over charges from the previous months. I am the one who contacted the bank and tried to resolve the situation as soon as I became aware of it.
The lack of concern and compassion for the situation is disheartening and disgusting. I understand the department that was handling the loan modification deals with clients that haven't paid their mortgages for months and in some cases, years, as expressed to me by Ms. **. But my hope was that I would be considered based on my individual account, not against all the other customers that Bank of America has. I have never been late before or missed any payments and was hoping that would have been looked over before the late charges and the report to the credit bureau. I am hoping that from this letter, I would be taken seriously and that this is a big matter. I started the loan modification in hopes that it would help me lower my payments and just make things a little easier. However, it backfired and affected my credit score and ability to do other things for years to come.
I would like the late charges to be credited back to my account and I would like a letter to be sent to the credit bureau retracting that I was late. I would like a full investigation into the accounts that Ms. ** handles because when you are dealing with people, their money and their livelihood, it is important to have someone who knows what they are doing and cares about people. I work for the retention department at a large telecommunication company and would never treat people the way that Bank of America has treated me. My credit report shows no late payments or missed payments for several years and should show proof of my desire to wanting to have a positive credit history. To go back to what I was stating earlier, Adam the manager either lied to me about his name or the notes on the account given to me by an agent was not noted properly. According to the notes on the account given to me by an agent in Tempe, Arizona by the name of Natassja, who by the way was very kind, said the manager's name was Anthony ** (spoken to on April 10).
I will be contacting the Better Business Bureau and Consumer Affairs and whoever else is required because this is not only wrong, but it has become very unethical. I will provide phone records to show how Ms. ** only called me once during the entire loan modification process. I strongly recommend an investigation into Ms. **'s other clients accounts because it is important that this doesn't happen to other people. I have phone records that show the amount of times I called Ms. ** and am surprised that as my account manager, she didn't make me aware that a payment was missed if I called to make a payment for the following month. I will also provide a copy of my statement that does not show any past due charges so I would have not been aware that my payment was never posted.
I will provide any kind of information that I can to show that what I am saying is supported and that Bank of America claims to want to help retain people, but is only lying to customers to get them off the phone faster or to not help deal with the situation. I will continue to pursue this matter until it is resolved in a proper and respectful manner.

We have a BOA loan and we cannot get them to do anything to help. All we get is the runaround, send documents and never get replies other than send documents. We were told we were getting a modification over a year ago and now we are not getting it. They say FHA won't allow it anymore. I have tried for days to get in touch with someone at BOA and all I get is leave messages. I have companies calling me about taking over the modification, but want money. One called today, the American Consumer Advocate Law Group and they are telling me BOA did all this just to take our home, that the government will give them more to foreclose on a home than if they help the homeowners out. This issue with BOA have us so stressed that I am afraid my husband will have another heart attack and not survive. He is terminal and this added stress is not helping. Is there any actual true help out there for homeowners wanting to keep their homes?

Our mortgage company, Bank of America, claimed that we owed money that we disagreed. But instead of losing our home as threatened, we sent thousands of dollars. We were put on a modification program and after a year, we were told we weren't on the program and we still owed thousands of dollars. We have been going through this since 2009. Being told they didn't receive payments or they didn't receive our paperwork. We contacted Fannie Mae to assist us and they gave them problems. Every time I call BAC mortgage, they have me speak to another person who has no clue on what is going on. It's now been three months since Fannie Mae submitted all our paperwork and we have yet to hear anything. Please help. I have a disability and suffer from a nerve disorder and all this stress is making my disability worse. Thank you.

I have filed a formal complaint through the Consumer Financial Protection Bureau against B of A (BAC) for illegal inspection fees, return payment fees (NSF) and not applying additional principal to my loan. When B of A acquired my loan, they began to lose the payments when sent through the USPS. They charged me late fees. To resolve this problem, I began to send payments via express mail. B of A said there were no payments inside the envelope or that they did not receive it. I had to fax proof that the payment was signed for by one of their representatives (more late fees).
The next step was to send the mortgage payment through Western Union. Even though I can show the time, date and amount that was sent, B of A continues to charge me NSF and inspection fees. My loan has been current for years! Now, I make my mortgage payment online. Still more fees. How can I legally fight these thieves? I have documentation to prove payments.

We started doing our loan modification in our house on September to October of 2011. It was approved and we were granted a trial period of 3 months - November 2011, December 2011, and January 2012 - which we paid the amount that they had sent to us in the trial package. In December, we got the final documents for the loan modification and we signed, notarized and sent them back to them. In January of 2012, we were told that we had been approved and we were given our monthly fees for the first 5 years, the 6th year and the 7th and after years. We started our new payments in February 2012 and have made 3 payments.
We were not contacted until April 3 by a representative from BofA saying we were late in our payments. We have proof that we either paid the monthly mortgage payments on the first of the month or before the depending on when the 1st fell on the day of the week. We've been trying to resolve the matter with them, but we have been given the run-around. They transfer us from one department to the other, just saying that they cannot help us. As of this week, BofA employees are giving us different amounts that need to be paid to bring our account into balance anywhere from $1000.00 to about $6000.00. Since we started the process, we have dealt with about 10 different people that have been assigned to our case; each one has a different opinion and some of them we have not even spoken to them.

I've been trying to modify my home loan for almost a year. Every time, I'm being asked to send over papers about 12 times, same paperwork. I've been denied five or six times. I was currently laid off. My wife is the only one working right now. We currently own two homes. We've been home owners for 10 years now. The first loan was with Bank of America which was sold to another bank after the second loan which is with Bank of America. We have two small children living here at this home.
Recently, we have a person who walked up to the door with a list of names. He asked my name and I said yes. I answered, "What's this about?" He said, "This is about making sure you don't abandon your home, making sure you don't walk away." I said, "Excuse me. I have two children. How can I walk away? Who's going to take me in? I have my family here. I can't just get up and run off. I'm only behind two payments." I've been loyal for 10 years. This is a disgrace. This is what we get on a bad economy, people pushing you around for being late. Two payments after 10 years, Bank of America, are you kidding me? This is the thanks I get for being loyal to you. You keep denying my claims instead of modifying my loan to help me stay there. You're the worst bank I ever dealt with. I will email the president about this. I will contact the news media. You will not take me for a fool. I promise that I will never give up. Mostly everyone knows who you really are.

I have had my home off the market for quite some time and I finally found a buyer. We agreed on a price and met at the title company to open up the escrow proceedings. The buyer at that time produced an "Approved Loan Certificate" from BOA. The document read as follows: The presenter of the Approved Loan Certificate has been approved for a home loan and brings with them the instant credibility of a serious home buyer. When doing business with the preferred buyer, you know the strength of Bank of America, NA is behind them. It then included the buyer's name, sale price of the home, loan amount, loan type and expiration date.
It continued with the following paragraphs: All terms will be adjusted and reflected upon actual dates and verification of deposit receipt, and any adjusted underwriter requirements by FHA guidelines for this loan. Borrower to present this certificate to their real estate professional, seller or home builder as proof that they have been approved for a home loan with Bank of America, NA.
The following day, I left on a ten day trip out of state searching for our dream retirement home. We located just what we wanted and placed it in escrow. I paid for the two inspections that were required by that state and returned back to California. I then paid for a termite inspection on our home and delivered it to the title company. I was shocked to find out the deal was off! BOA said they didn't have all the information required from the buyer. My first response was how could you issue an "Approved Loan Certificate" if you didn't have all the information? I proceeded up the chain of command of BOA trying to get an answer. I felt the least they could do was pay for the expenses that I put out during this ten day trip. I talked to six different individuals before finally ending up with someone in the bay area. We had several back and forth conversations with no results that satisfied me.
I finally asked to speak to her supervisor and she indicated that was not possible. I pointed out that I surely had the right to speak to someone above her. She finally indicated that someone would call me back. Five minutes later, the same lady called me back and said there was nothing they could do and that if I had further concerns, I should contact a lawyer. I had another phone number that had the same area code so I called that number and the individual never returned my call. I have been a member of BOA for forty plus years and I guess it is time to find new reliable bank!

I have called several times to find out about my account. Each time, I get the same account manager that gives me the complete run around. For several months, there has been a $20 fee due on my acct. I have questioned this fee several times even up to today. I'm told it's for a check for my mortgage that was insufficient funds back in December 2011. This is now May 2012. Each month I give about $19 over my mortgage.
On April 16th, I called Bank of America to ask a simple question and I get this same acct manager. I asked the question and she could not give me a simple answer. She said I owe Bank of America $20. I asked again how. I was told the same story again. I asked the bank manager to process the $20 from my checking account which she did. I asked her flat out, "How much do I owe now?" The account manager said that my account was was current and the $20 fee due will reflect on my acct.
I asked the account manager why when I called, I get her. Her answer was, "Oh, back in August 2011, you applied for a modification." I never got the process started because of the run around Bank of America customer service was giving me. I never ever received the paper work. The process was insane. I mean I felt like my head was spinning between one acct manager to another.
I was laid off in October 2011. I told Bank of America acct manager several times and I can't tell you how many times she gave me a number to call to explain my situation and each time, I was told "you cannot apply for this service if you are unemployed". I'm very frustrated because this is no time to BS me. Each acct manager should know what services are available for whom. I asked my acct manager to remove herself as my acct manager. I no longer want her to represent me in any form or fashion. I have tried for months to be nice about the situation. I've had it. I have become totally disappointed and disgusted with Bank of America service.
I am sending this email to ask that the account manager please be removed from my account. I do not want to call the bank and I'm told she is still my account manager. I have tried my patience with this person. Please, remove her as my acct manager. Please.

Bank of America Mortgages had screwed up my account royally. I have written the full board of directors twice and have been on the phone numerous times. I want them to forward me a history of my account and I cannot get it. It has now moved to damaging my credit. Their records are wrong. I went from a very high credit score to a mediocre credit score because of their continued errors and no one will look or review the account.

I bought my house in December 2007. When I received a pay cut and lost my job, I continued to pay my mortgage. I called several times and asked for help or if there was any programs that fit my situation. I was told I never missed a payment and there was no programs for me. January was my first time I missed a payment and I was told to fill out a loan modification form. I was told there was a chance that I would get denied because I didn't have any income coming in. I didn't get a response in the time frame I was told. I told the bank I would try to sell my house since I'm going through a divorce, my soon to be ex husband didn't want to cooperate.
I reapplied for the loan modification. It's been a long process and I still do not have any answers. I was told they received all my paperwork which I sent 4 times. I constantly call and get nothing but the runaround. When I talk to my account manager, I'm told several things, different things. This week, I was told my application hasn't been processed and it had been a month since I was told they received everything. I'm so frustrated and been going through this since December. I just don't know what to do next.

Complaint on BOA Home Modification Program: After being passed around from person to person in the BOA debt collections dept. for 3 to 4 months and not being able to find a person we could speak to and ask who was supposed to be in charge of the account, my wife finally was able to speak with a real person at the bank to explain what had happened. They created a file and we were told to call at anytime and that our file would be handed over to the modification department for review and consideration. We received a letter by mail, telling us we did not meet the criteria for consideration for any of the BOA programs.
After hearing news concerning the President's new program to save homeowners and their homes, I called back to BOA and requested further assistance in applying for a home modification hoping to qualify for one of the new programs. I met the criteria of being on unemployment for 8 months, from March to November. I was unable to connect with anyone except those in the collections department and they were of no assistance and you couldn't get past them to speak with anyone else.
On December 8, 2011, my wife attended the foreclosure prevention session sponsored by the Durham Regional Financial Center, Durham NC. On January 18, 2012, our request was submitted for modification. I. **, Loan Modification Processor, Durham Regional Financial Center, was acting on our behalf. On January 20, 2012, we received from BOA the first notification of foreclosure sale, Ln# **, 1st foreclosure hearing. "Please note that the hearing was continued to 2/28/2012 and the sale date was moved to 3/20/12 at 10:00 a.m. in order to release any loan information that is not public."
On March 6, 2012, our request for home modification file went to BOA for underwriter review. The home remained in foreclosure status. Communication from the bank slowed then stopped. On March 26, 2012, I received a letter from Kimberly **, BOA Home Loan Team, advising they wished to work with us directly, as the information from the HUD office was too slow and inconsistent. She needed additional information to continue the application. This letter was forwarded to our representative I. ** at the DFRC. A call was made to Kimberly **, as a follow-up to ensure the information had been received. I called to the number provided by Kimberly **, 1800-669-6650. This number was connected to the debt collections dept. I asked to speak with Kimberly **, after being placed on hold. No one knew of a Kimberly **. After being placed on hold, I was told she was in another department, and she can only be reached through e-mail. An e-mail was sent to a Kimberly ** to call the home number provided. The call was never returned.
On April 2, 2012, I called again the 1-800 number and asked to speak with a supervisor. I was provided a number of Nicole **. I was told she was the supervisor of the person, Kimberly **, I was trying to reach. I called and left a message 3 times, no response. On April 28, 2012, we received a letter from Stacy ** advising our request had been denied due our total mortgage requirements not equal to the 31% of my gross annual income.I called to the bank at the number provided and was again connected to the debt collections dept. I asked to speak to a supervisor; I was connected to a person named Jacqueline, 877-201-4218 ext. **. I asked her to connect me to either Stacy or Kimberly. I was told by Jacqueline that they (Stacy or Kimberly) were no longer associated with the case since the modification was denied. I asked if there was a supervisor I could speak to from that department. I was told the account had been turned back to this (Debt Collection). When asked who she was, she, (Jacqueline) titled herself as a Credit Advocate. I asked why I couldn't speak with the person that was taking care of my case. She (Jacqueline) told me she could resolve any questions.
I asked why the modification was turned down. Her reply was that I didn't meet the qualifications. I told her the difference in the percentage was $60.00! Jacqueline's reply was the investor was no longer interested. The investor who? No answer. I asked, "Why didn't the people from the Home Loan dept contact me to work through this matter?" She told me they were no longer assigned to that account. I asked, "Is there such a department, Home Loan Department?" No response! I asked, "Who can I talk to about saving my home?" She (Jacqueline) told me I could sell the property or take a deed in trust. I told her either way I would lose my home. No answer!
I asked her, "Is there any other way?" She replied, "Pay it off." I asked her, "I just started back to work. I am trying to make some arrangements to save my home but what you are telling is, I can't!" Jacqueline replied, "Pay up the interest and the back payments and ask for a reinstatement." But there is no guarantee they will agree to do it. I asked her, "Where can I get that kind of money?" Jacqueline replied. "Ask your family." End of conversation.
We have had two court continuances regarding BOA and their delaying tactics. We are no further along now than we were when we first started. In fact, we are right where we started. We are due for another court hearing in May. This is the consequence: Unless we can get some assistance or intervention, we will lose our home

Approximately 2007, a loan officer by the name of **, an employee of BOA whom is currently with Stellar Mortgage, altered the refinance loan application with Bank of America and noted that I did not qualify for the loan, but had showed more income than I originally made and had monies transferred from her bank account at American Savings into my American Savings, and later, had it transferred back out after the loan was approved. In September of 2010, we were served with a foreclosure notice after my fiancé could no longer afford it and I was not employed for approximately 2 years prior to the foreclosure. I'm not seeking for any monetary damages. I need individuals like her to have their licenses revoked and not be able to practice in the lending business.

I've been trying to get a loan modification for some time now. I can't speak with anyone, my papers are being shuffled around. I have been trying to speak with my case manager, her manager, so forth and so on. No one is returning my calls. I submitted paperwork in a timely manner. I even have a counsel working on my behalf and he too is having a hard time. Please help.

I lost my job and applied for MHA on my 1st mortgage in 8/2011. I've never made a late mortgage payment in the six years I've owned my home. After faxing and mailing the required application papers and documents to BofA multiple times, there were continuous requests arriving in the mail saying that I was still missing this form, or that proof of something. However, I was diligent about being organized and know that I sent everything as it should have been. Every time I called for for answers, it took weeks to get a return call and most of the time, they weren't even aware of the paperwork I received, always saying everything is fine.
In 9/11, I got paperwork informing me that my 3-month trial modification was approved and that I should call in each payment during those months. The first time I did, I immediately noticed the tone of the representatives had changed. They informed me that they are debt collectors! I asked what for? I wasn't behind in my payments and have a great credit score. They didn't seem to know why I was in collections. In 1/12, I got paperwork saying my modification was final. Two months later, I received a notice stating that my account was being accelerated and something about foreclosure! Stunned, I called BofA immediately and continuously for weeks! No one would talk to me and would only refer me to my relationship manager, Laura **. I left her 27 voicemails over the course of a week. I called her supervisor and her supervisor's supervisor and left them messages on a daily basis. This accomplished nothing. I never got a call back.
Finally, I called BofA and did not enter my account number, claiming that I didn't have it, and when I got to a human to speak to, I desperately begged them not to forward me to my relationship manager but to please, please help me understand what was going on with my account. It was discovered that BofA was applying my mortgage payments to the wrong account and they told me I hadn't made my payments in three months! Although, they had cleared my account! After five hours on the phone with four different customer representatives, it finally got worked out. But then, I received a check in the mail, first for half of my payment amount, saying they don't accept partial payments. So I cashed that and sent out a full payment. Then, a few days later, I got another check for the other half from them with same message! So frustrating! Sometime later, I got a check for $1 with no explanation at all. By this time, I'm wishing my loan never got sold to BofA.
I then applied for the 2nd loan modification in 2/12. I sent all the paperwork in twice and keep getting requests for the same paperwork. I've tried to call my relationship manager, who never seems to know anything about her job or how to do it, and for weeks I've called multiple times a day leaving messages and no one ever calls me back! I'm so fed up with these extraordinarily incompetent people. Good news, though, today I called the Making Home Affordable HOPE Team at 877-300-5454. They are a non-profit organization in place to protect homeowners and ensure that the lenders are following the federal guidelines for home modifications. The man I spoke to was immediately responsive to what I had to say. He conference called BofA and got someone on the line right away to explain the status of my modification. He accelerated my modification out of the BofA collections dept and assured me that he would be following up on my account and checking in with me in several days to ensure a resolution had been made. Finally! Someone who listens and helps! I encourage you to call and see if they can't also help you!

I am a contractor that was hired by homeowners to do repairs to homes that burnt. The insurance sent the check to Bank of America for them to distribute as work is done. BOA has done everything they can to not pay for work that is done. If you want to see what type of company you are dealing with, tell whoever you are talking to at BOA that your are going to record their call like they do and they will tell you that you can't record their calls and for you to stop. If you don't, they will hang up. It's kind of funny how they can record your conversation but you aren't allowed to.

I just received a check in the mail from BOA for the amount of my mortgage payment paid for April. They returned it saying they do not accept partial payments! What partial payment? I am livid. They said they sent a notice in March letting me know that payment would increase in April. Nope, no notice. I just talked to them and told them that I would resubmit payment in new amount but not incur a late payment. They said I will be charged a late fee and it will be reported but that I can fax a letter to them asking to forgive. Seriously? Does anyone have any suggestions on how to deal with these people? My mortgage was sold to them less than two months after closing on my house, and I am not in a position to refinance at this time. I feel totally helpless. My priority is maintaining a healthy credit score. What can I do?

Bank of America agreed to modify my loan since I lost my job in 2009. At first, they made a reduction in the monthly payments (forbearance) until I get a job. Once I got a job in 2010, they told me I make too much money for loan modification. So now, I need to pay them all the back payments, interest and late fees if I do not want to be foreclosed on.
Since I did not have $30K to pay, they start the foreclosing process. Quickly, I hired an RE agent, and since I had a beautiful house in a very nice area, I got multiple offers. My agent presented an offer to Bank of America for $749,000 and while we were waiting on the bank to agree on the offer, they went ahead and auctioned the house for $471K and sold it for $651K. How this was possible, I have no clue! Later, I found out that the investor who bought the house knew about the auction from the Bank of America insiders. He made $128K in a month as he sold it quickly for $779K. I have no idea how a bank can do this as they could have completely get their first and second loan paid off.

I applied for a modification on Feb. 2010 and received a perm. modification. After paying the modification payment for 2 years, I received a letter stating the modification didn't go through and my home will be foreclosed. I called every month, 2 and 3 times a month, trying to stay on top of this modification only to get different people on the phone with different answers. Now, after 2 years I've been appointed a case manager and basically he's telling me that whatever I do, I have options to be foreclosed on. I'm outrage over the mishandling of the case and the run around for 2 years. I have invested too much money in my home only to have it taken because Bank of America has too many people with their hands in it and no one knows what's going on. I was recently sent a check in March for $840.00 stating that Bank of America doesn't accept partial payment, but I was paying the modification payments. What are we supposed to do when we are told one thing and receive foreclosure papers? I have the copies of the perm. modification papers where it was approved.

My mortgage is with BoA. I was in the modification process for two years when all of a sudden, the person I was working with called me and asked if I had received any paperwork from BoA. He was very nervous. I said no, what is going on? He said he did not know, but as the conversation went on, I realized my home had been sold at auction, which I was never told about. I complained loudly and went from manager to manager until I got someone that got the sale "rescinded" as he told me. Freddy Mac had bought the house, but since they did not follow what they needed to, they cancelled the sale. The eviction papers came and I contacted BoA again and was told not to worry, we were okay.
The modification process went on and soon we had an offer from BoA for $900 more per month than our current mortgage. I said no, we needed to do something the other direction and was told not to worry, it was only for 343 months. I said no again. This was in April of 2011. I never heard from them again until now and my house, in fact, was sold back then and we have to move out. Today is much different in Arizona than a year ago as far as the real estate market goes. I can't get a rental, homes have gone up in value and I am in trouble. What legal options do I have? Any ideas would be greatly appreciated. I have not moved, but have been given an eviction notice. I now understand why they gave me an increase instead of a decrease. My home had already been sold at auction to Freddy Mac. My mortgage is $416k and the house is only valued at about $220k in today's market.

We got into the home modification process in the summer of 2008. After repeated tries at filling the paperwork out correctly and having it actually get to someone (I must have faxed it all five times), I received a phone call from Rafael, the person working on my case, asking me if I had received any paperwork from BofA. He was very nervous and gave me a big runaround in the discussion. I told him no I had not but I quickly found out that my house had been sold to Freddie Mac with no notification to me at all. I got on the phone and finally got a manager's manager that told me that due to their mistake, he would get the sale rescinded. I then got the eviction notice and called him back. He told me not to worry that it was back at BofA and the sale was as if it never happened.
We went on with the modification process again and again had paperwork problems from BofA's side stating they never received faxes or emails. We finally got through that and was given an offer for our modification of an increase of $900 per month. This was around June of 2011. The sale that happened and was cancelled was in April of 2011. From June 2011 until April 2012, I never heard another word except that when I called they told me there was no sale date scheduled. Now in April 2012, I find out that the sale in 2011 was never rescinded and that I was now expected to move out. Freddie Mac still has the ownership from the original sale. What are we to do? I am looking for a lawyer to get involved with a $10 million lawsuit.

Tax escrow and application to lower principal - In 2009 I applied for 'Hardship for Homeowners' because my husband passed away in 2008 and I became 100% disabled a few months later. After they lost my paperwork a half dozen times in 2 years, they lowered my interest rate from 6.75 to 6.125, $30 reduction. I had to have papers notarized at my bank for them to handle my escrow account in 2011, it is April 2012 and I just discovered my escrow is going to be $505 short for my summer taxes. I talked with them yesterday and of course no big deal to them; I can just add $165 to next 3 house payments. So I guess I don't get to eat or leave the house this summer.
Bank of America had a link to apply for a reduction in principal. I did everything and put the paperwork together and was told I had to go to 7 Mile and Evergreen (very bad area of Detroit) for an interview. Immediately the counselor was more interested in me putting my home on a short sale. I told her I did not want to move and my house is worth $27K less than I owe after 14+ years of on time payments. Three days after I went there, I received a letter saying I was not eligible for the program. I feel the entire thing was a scam to bust up my neighborhood worse than it already is. The CEO's secretary claims it wasn't.

I am a Realtor in St. Louis, Missouri. I have a contract on a property that was listed for sale by Bank of America. The contract was accepted in January by BOA. We have not been able to close because BOA will not sign what is required by the state of Missouri and city of St. Louis, which is called an acknowledgment letter. Until BOA signs this we are unable to close this property. The title company cannot get any movement from BOA the listing agent who has contact with BOA's asset manager can't get anywhere.
In February, BOA required us to us to release the property, write a new contract and start over telling us we could close in April. Now, we are three weeks out from our closing date and they will not sign this acknowledgment letter, which says they own the property that is all it says. The title company will not close us until this letter is signed and recorded with the city and made public. The city of St. Louis is running three weeks behind in recording of deeds so we will not be able to close on what is now the third new closing date with no idea as to when we can close as no one knows what the holdup is. The property address is ** St. Louis, Mo 63116.
Can anyone help me? The property has been vacant for over two years and one would think they would want this off their books. They chose to foreclose and take ownership but will not sign the acknowledgment. Thanks for wasting everyone’s time BOA.

We qualified for a modification in May 2011. We received our 3 trial payment packet instructions mid-May 2011. Our first payment was to be June 1, 2011, then July 1, 2011 and finally August 1, 2011. Then, we were supposed to get the finalized paperwork to make it permanent. We are still waiting. We are now at trial payment 11 of Bank of America's modification. When we called for status, the representatives were sympathetic, apologetic and human. That is no longer the case. Now you can only speak to your case worker and if you call when he is out of the office, you are out of luck. You cannot speak to anyone else.
When he calls you back, they have trained him or went out of their way to find someone who responds like unfeeling robot. If he thinks your voice is showing the least amount of emotion, he tells you immediately to calm down and not get excited. If you ask questions, he tells you to calm down and not get excited. When I ask when I will be getting the final paperwork for the modification, he said "whenever Bank of America sends it".

We tried to get Bank of America to help us and like other families, we were having a hard time paying our house payments so we went to Making Homes Affordable back in 2010 and 2011 back in Sept, 2011. I had a rep named Chuch ** from Bank of America telling us to send in my paperwork to him and he would get back to me in 72 hours and to just send him all the paperwork. Well, the return address was sent back to me so I called the bank and they said that they would email him. So I sent it again and it came back to me. It said that he had moved. I tried to call him and left message with the bank and tried to call his boss, Jerry, so I went to MHA. I got an Angela ** and she was going to help in Nov. 2011 to stop the sale date of Dec. 22. 2011.
On Dec. 6th, all was looking good on the Dec. 9th, 2011, the bank said they got my paperwork to call in 20 days. Well in 9 days, they sold my house. Two days before Christmas, a man came to my door and said he work for the new owners. We had one month to move. We have lived in this house for 35 years, have 5 kids and 6 grandkids and one great grandson. I called MHA. No answer. Then the bank and they said we were not on a program. So we went to court to see if we could get more time. The courts are for the new owners, not us. I could even get the judge to look at me and hear what I had to say. I pay my taxes and the bank took my taxes money to help them and now they get my house too. I tried for three months to get an answer but they said they tried to call. Mrs. Angela ** did not get back to them. So why not call me?
Now the bank is having all the CEO's of all the banks (Bank of America) write me and tell me that they tried to call me and MHA. So I don't know if I am coming or going. We got no moving money on where to go and 35 years of things to move. What do you take and what do you leave? This house was my mother-in-law's house for 45 years. Just look in your home and what would you take with you? I almost lost my mine if not for the love of my kids and family. Someone should tell me what happened and why no one told us back in Nov. 2011 that they were not going to help us. We could have done something different. Now we have no home. How are the banks doing this? I have read a lot of story like mine and God bless you and your families. I know what you are going through. Can they do this? I want my house back.

I started a loan modification in February of 2010. The test period for the modification was completed in June of 2010. I received a "Loan Modification Clarity Commitment" in October of 2010. The modification received final approval in Jan of 2011. BofA has now continued to report me as 30/60/90 days past due on my credit report. I have over 12 times and every time they claim it is a mistake. I have not been late on any payments and they have continued to accept my payment.
In November of 2012, I received a letter "Notice of Intent to Accelerate". I called and they again said it was their fault and would correct the problem. They have been taking my payment and not applying it to the loan and at that point claimed I was over $30,000 past due. I have received multiple calls from collections agents who then apologized for the mistake.
Every time I call they have to send an e-mail to another department to try and resolve the problem and claim they will call me back. I have yet to be called back by anyone who has said they would. They still have yet to update the loan with the correct payment amount. They claim I am now $5,000 past due. Again, every time I call they admit it is their fault and they will correct the loan and the problems with my credit and have not done so.

I made all my modification payments on time. They FedExed me a paper to be stamped with a notary and sent back with a month's rent. The problem was they wanted it back the same day as I received the FedEx envelope. Seeing as I just paid them a month's (March) rent with a photocopy of their coupon, I waited until I had April's rent to send everything. I got a returned letter which said that I am disqualified for the modification because the paper was late. All my payments were on time, and they agreed. But because this paper that I received on the day it was due back was late, I am disqualified. What I don't understand is that if these papers are so vital to the modification, why does BofA send these things without having to get a signature for delivery? This whole modification thing is a scam, in my opinion.

After closing on the sale of our house on March 28, a payoff check was overnighted to Bank of America via FedEx. The payoff requested by the title company was valid through March 30, 2012. It was received by BoA on April 2. On this day, the title company was contacted by BoA. The bank said that the payoff was $1000 short. The title company contacted me, the seller, and asked that I call Bank of America on April 3 to investigate further. All 3 of the individuals, whom I spoke to, informed me that no check had been received (though it had indeed been signed for) and that they could not help me any further.
I called the title agent back, and we conferenced in BoA. We then spoke with a customer service representative who added a person from the "payoff" department at Bank of America. After investigating the issue, it was found that the check had been received and was being processed by the payoff department. The person we spoke to after an hour of research (Niquea **) confirmed with my self and the title company that the payoff check would be applied to the loan and it would be closed out at the end of the day. Also, we were informed that the returned "partial payment" of $1000 was mine to keep when it was received, as it was included in the payoff amount's total that was quoted to the title company.
Today, April 10, 2012, I was contacted again by the title company. They explained that the payoff check had actually been returned to them with a letter that explained that it was a partial payment. We called Bank of America again on a conference call. They explained that the check was short $57.00 in interest that was accrued on March 31, April 1, and April 2. At this point in time, we offered to wire the payoff amount quoted at the time plus the interest accrued until April 3 (the date that Bank of America's payoff department assured us that the loan would be closed out and paid in full).
The manager (Erin **) we were speaking to today (April 10) said that they would not take any responsibility for their error on April 3 and that they are charging us interest for every day in between as well as however many days it takes BoA to process the payoff (at $19.55/day, in addition to the $1000 that they included and later sent to me for an incomplete payment a month later). After an exhausting 1.5 hour on the phone with Bank of America, we realized that they were not going to take responsibility nor try to resolve the issue with us. We asked Erin to fax a confirmation of the information on the payoff amount for today to the title company. She assessed a $30 fee for this fax without informing either of us.
I am complaining to BBB, because I should not be held responsible for Bank of America's miscalculation on April 3. They should have told me on that day that the loan was short in any amount and I would have addressed it promptly. Instead, they neglected to contact me and allowed the interest to accumulate without my knowing. As I previously mentioned, we were informed that the loan would be completed at 1210 on April 3, 2012.
I have never experienced such poor customer service. I almost feel like they are encouraged to take whatever they can from their customers. Although I am certain Bank of America doesn't care in the slightest, I will never use another BoA service of any kind, including their ATMs. I'm even going to change the channel if one of their commercials come on TV. This company is opportunistic at the cost and pain of their customers. They should be ashamed of their selves, every last one of them. I want Bank of America to refund the interest accrued between the dates of April 4 and April 10, 2012. Their representative informed me on April 3 that the loan was paid in full and I owed them no more money as of 1215 on that day. If we were made aware of the shortage and accrual on April 3 when we called to confirm the payoff, we would have promptly responded to the issue.

My story sounds the same as most on here. I lost my job last fall and I called BOA then to seek out assistance with their home loan modification program. That was in October 2011. It is now April 10th 2012. I received a letter saying I was denied yesterday as I did not submit all of my paperwork on time. This is not true. I have been asked to continually submit additional paperwork which I have under their time frames. I had to re-submit all my material in December and January as their process takes 30-45 days to review, and my information was out of date after they decided to review it. I sent in paperwork for the third time in January and have been asked to submit additional information since then.
I have fax confirmation, email confirmation, and I started recording my phone calls to my representative, Scott **, as I read all the complaints of this process about BOA, and believed they were trying to put me in foreclosure rather than help me save my home. I have supplied everything they asked for and I am lucky I called my representative each time for clarification because if I sent in what their form asked, it wouldn't have been all of the additional information that BOA was seeking. I have left 3 messages and an email and have not heard back from anyone. I hope to save my home but have no idea where to turn now. I have no money for attorneys nor resources to pull from. I financed my home in 2005 with Countrywide that was sold to BOA. I am amazed that they can get away with this especially after their bail out.

While refinancing my mortgage, I ran into the NYS Mortgage Tax where basically I have to pay the tax twice if the lending bank does not agree to fill out a CEMA document. Unfortunately, the lending bank was Bank of America, which is notorious for delaying the process by 8-10 weeks in hopes to hold on to their "customers". I waited the time and they procrastinated to the point where I simply had to pay the full tax twice. I simply could not be held hostage by BOA any longer. I am filing a complaint with the NYS Banking Authority and State Attorney in hopes that BOA will be investigated for this practice. By the way, they want $700 for this which I had to prepay. I am hopefully getting this money back.

In November 2010, I asked Bank of America to help me to arrange a way to repay my delinquent payments. I was 60 days late due to my wife being laid off her job 15 months previous. My wife had recently gained new employment and therefore I was trying to get caught up. Jeff, BOA's representative came up with the following repayment plan. I was to send in $500 then (about November 20th). Starting in December, I was to make payments of, as I recall, about $1748 per month for 6 months. Jeff told me that at the end of the 6 months, I would be current. He also told me that as of the first payment, BOA would quit reporting to the credit bureaus until I was current.
I made the December payment. Then in January, my wife's hours were cut back to part-time. I called BOA and told them that I would be unable to continue with the larger payments. They told me, "fine Mr. **, just return to your regular monthly payments" which I did. The following September, I received some funds making it possible to catch my loan up completely. When I called to make the 2 payments I was behind, they informed me that I was 90 days late instead of 60. I said there must be some mistake. Upon further investigation, I was told that the 500 dollars that I sent in back in November of 2010 had been applied toward late fees and that caused me to go another 30 days behind.
After the dust settled, they agreed they were wrong to do this without informing me and they retrieved the 500 dollars and the amount of the December payment that was above my normal payment setting me back to only 60 days late. However, they still refuse to file a correction with the credit bureaus. All three show me as being 90 days late from December of 2010 through Sept of 2011!

In November 2011, I responded to a notice from BofA who holds current mortgage of refinance opportunity. I contacted BofA and requested to refinance through Make Home Affordable Program. The process began and many months of requests for documents to be signed as others on this "consumer complaints page" talk about - requests for full pages of assets and months of checking accounts statements, etc. were requested. I was led to believe on March 27, 2012 that the closing was eminent.
Unfortunately, the day I sent two months worth of full checking account statements, along with statement of where the "large" deposits came from, I was told that the case was closed. The reason I was given was - Freddie Mac holds your loan and are not accepting any new loans that were started prior to December 1, 2011. I spoke to the person (in charge of my refinance) who stated "I am on your side" many times, but of course the refinance did not happen.
I contacted Consumer Financial Protection Bureau #855-411-2372 who is tracking response - Recommend to all to do same as they are as reported by them to be responsible for regulations of banks. They did contact BofA with request for response to my complaint. I did get a call from someone supposedly from office of the CEO of BofA. The only resolution offered was to start over.
I am fortunate that I do not have to refinance, but of course would save money if I did. So, at this point, I am planning on at the least filing in small claims court for the maximum allowed in my state of $5,000 for money paid out for appraisal and subordination of $200 (not sure where this money went as it was paid to BofA) and the amount of money I would have saved if BofA practiced truthful working practice and gave me the refinance. Continue on your reporting and I hope others follow my lead with suing BofA in small claims court, as they continue to get away with unethical and financially harmful behaviors to the many.

I refinanced my home in early 2012. The reimbursement from the payoff is $4700.00. The loan was paid off on March 2, 2012. The bank claims that the check was sent. I have lived in the same home for 11 years and this mis-delivery has never occurred in the past. The first check has not been cashed; they agree, but they refuse to re-issue the check and send it to me. They make promises that they will do this, but it has not occurred despite dozens of calls from me to customer service. I have made my way up to two levels of managers, yet they refuse to return calls. This is very frustrating.

I began this process nearly 3 years ago and am still no closer to my modification than I was when I started. I suffered a massive stroke and will never be able to work again. During my 3-year wait for my Social Security Disability to be approved, I never fell behind on my mortgage. Many of my other bills suffered, but I sold nearly every personal item I owned to insure my home was secured. Due to my disability, I can no longer live alone. Thus, a dear friend retired early, took her pension, gave up her home and agreed to care for me and contribute toward my expenses to ensure I could stay in my home. It was suggested to me to apply for a loan modification to allow me a few more dollars to pay for my prescriptions. Due to my age, I am not eligible for Medicare. So, I have to pay full price for my meds. The process seemed to start out well. B of A said that I was qualified for a program called "eminent default". I filled out all required paperwork and was told to meet with someone at consumer credit counseling. They told me to complete my modification first so the bankruptcy wouldn't show up and then contact them for a bankruptcy certificate.
I called B of A every other week and was told to keep paying my trial payment - I should receive my final paperwork any day. 10 months later, I received a letter stating that because I had never resolved my other debt, I was being denied and had 10 days to come up with $4300 to cover all difference in my payments as well as late fees or they would begin foreclosure. I was horrified. I had to borrow money from my caregiver, who had to sell her other car in order to help me to not only to pay B of A, but also to hire a lawyer to file for bankruptcy. As soon as my debt was released, I reapplied to modify my loan. I began again in mid 2011 and have faxed, FedExed and e-mailed everything that they asked for at least 7 times. My account manager, Evelyn **, said she had everything that the underwriters asked for and I should hear something very soon.
As of today, I have heard nothing from Evelyn, but I received a FedEx packet asking for all of my info as if I had never applied. It said that if I don't send the forms in by May 2, 2012, I may face foreclosure. I am not behind on my mortgage! So, today I tried to reach Evelyn by e-mail and by phone, but the answering machine says that my account manager is now Sylvia and no one will call me back. I don't see why we can't file a class action suit against B of A if we are all having the same problem. My original mortgage was with Countrywide and was sold to Bank of America. According to Evelyn, the underwriters are Freddie Mac.

This is an official complaint against Bank of America/Mortgage. I believe Bank of America is intentionally not negotiating a permanent loan modification with me because I only owe a little more than what my home is worth. I’m employed in the same job/position for 6.5 years (with multiple pay reductions). I have multiple streams of income and want to stay in my home.
Bank of America has no intention in reaching a permanent loan modification or re-casting our loan. I believe B of A is giving us a run around to wear us down and then eventually foreclose. Their goal is to take our house after 10 years of on time payments, $150,000 approx, which includes 6 extra pre-payments of about $1,400.00 each and $20,000 down payment. We have been to mediation and successfully completed their temporary loan modification program, which reduced our payment $150.00 a month, taxes and insurance included. The temporary loan modification was reduced from about $1,400.00 to $1,250.00 a month. My wife and I are a small family trying to raise our 8 year old special-needs daughter, who requires 24 hours a day, seven days a week, adult supervision for the rest of her life.
Summary of my complaint:
Our primary residence/only home we own was purchased in Oct 2002 (1581 sq ft, 3bd/2ba) for $200,000 price through Countrywide with 30 year fixed, $20,000 down and 6.5% interest rate. I have excellent credit with over 100 mortgage payments on time, no late fees ever and no refinance ever. I was still employed with the same job for 6.5 years (Clark County School District, Computer Tech). Separation was in 2007 with multiple pay reductions.
First missed payment was in June 2010. I met with Bank of America on August 5, 2010. Bank said I needed to miss over 4 payments before they could help me, so I did that. I signed up for mediation in the fall 2010. I took mediation course on spring of 2011 at UNLV. I attended mediation on April 8, 2011 with Bank of America and a mediator. Temporary loan modification was reached for June, July and August 2011 for $1,250.00 approx. Successful temporary loan modification completed and acknowledged by the bank. More paperwork requested by Bank of America then denied permanent loan modification. Bank said permanent modification would be honored if we successfully completed temporary modification. Bank of America requests $18,000 plus in late/missed payments and junk fees.
Details of actual events:
I originally bought my home back in 2002 here in Las Vegas, Nevada for $200.000, using a Countrywide loan with $20,000 down, 30 year fixed, 6.5 interest rate, excellent credit of over 740 fica score. In 2006, I had a career change and took a job in the Clark County school District as a computer technician. I have had the same job for 6 1/2 years. Unfortunately, there have been many cutbacks in the school district and I have had more than two pay reductions. In 2007, my fiancé moved on with her life and out of our house and that is when I started getting roommates. That was fine for 2 or 3 years, until I had another pay reduction. I missed my first mortgage payment in June of 2010. Until that time, I had never missed a mortgage payment or ever been late on a mortgage payment. In fact, I have approximately 6 extra payments to reduce my principle during that time, as well as over 100 mortgage payments paid on time.
By this time, Bank of America has acquired Countrywide’s loans and I met with them on August 5, 2010 at a corporate office on Green Valley Parkway in Henderson. I was basically told there is nothing that can be done until I get more than four or five payments behind. So on the advice of Bank of America, I initiated their protocol in hopes of attaining some kind of loan modification, or even a recasting of the loan.
As the fall of 2010 settled in, I signed up for a mediation program through the state of Nevada to meet with Bank of America and a mediator. I also met with an attorney to seek representation for the mediation. I gave him a down payment but soon realized I couldn't afford his $2,500.00 costs. Through the Legal Aid Center of Southern Nevada, I found a Mediation class at University Nevada Las Vegas which I attended early in the year 2011. I was hoping this class was going to educate and prepare me for the mediation. Though I learned some great stuff, I'm not sure it did a whole lot for my situation. I also got married in March 2011 for the first time in my life. With my new wife by my side, we both attended the mediation on April 8, 2011, without any legal representation.
The attorney representing Bank of America completely miscalculated my income, thinking I worked a full 12 months a year. So basically what happened was I didn't agree with the income thing, but did accept the terms of a three-month trial loan modification of approximately $1,250.00 a month starting in June 2011. I questioned B of A’s attorney in detail essentially expressing my hesitation due to the fact I thought they would not live up to their end of the bargain, even if we lived up to ours. The attorney assured me if we followed their guidelines, my loan modification would be made permanent at about $1,250.00 total a month. I was hesitant to sign and was told by the mediator at JT Law Group it was a good deal and I should sign it. This was going to save us about $150 a month total from the current $1,400.00 payment. After realizing how my income was miscalculated, I contacted the Office of Comptroller and Currency about the miscalculation of my income.
After completing a successful trial loan modification by my wife and me in the fall of 2011, Bank of America sent us a letter of congratulations for a successful completion. They asked for all our current paperwork again, which we did. Then another letter we received stated we owed over $18,000.00 in back payments, junk fees and penalties. Needless to say, the wind was taken out of our sale at this point and we didn't know what to prepare for or what to do. Through the fall of 2011, Bank of America continued to send us a second trial loan modification packages. In October 2011, the state of Nevada passed new regulations and guidelines that banks needed to follow or could face financial penalties or even worse. During this time, I researched ways to save my home because it was obvious my bank wasn't listening to me, for example NCAA events, etc.
Early in 2012, through the Nevada Atty. Gen.'s office, the National Mortgage Settlement Act passed. This not only brought hope to my wife, me and our special needs daughter, but that even our Gov. of Nevada Brian Sandroval was looking out for residents of the Silver State by hosting an event at Cashman Center in Las Vegas for families and people trying to save their homes.
On March 9th & 10th 2012, I attended that event for over 10 hours. I basically gave all my updated information to Bank of America for the 4th or 5th time. Some of the information they accepted in my mediation almost a year ago was not accepted this time, specifically child-support for my wife's seven-year-old daughter. This time, the bank wanted the court order, which I had and gave to them.
As of today April 6, 2012, my family and I are completely in limbo due to what I think is completely negligence on behalf of Bank of America. Everything has gone silent. I imagine the bank will ask for all my information again in the near future. B of A accepted a $25 billion bailout by taxpayers like us back in 2008 to help homeowners who were still employed, originally bought a home with good credit, had money down, got real loans and never had any missed or late mortgage payments ever. We want to stay in my home. We have income, we have jobs and we want Bank of America to be held accountable for the constant charade they have been putting us through. We are tired of their run around games and the hamster wheel we have been left on.

Subordination Agreement: I bought a home in 2005 using an 80/20 loan to avoid PMI. The subject of this complaint is regarding the 20% 2nd mortgage. My originating lender for this loan was Oak Street. It was then immediately sold to Wilshire. I had zero issues with those lenders during my tenure with them. Out of the blue, my loan was sold to Bank of America. Since February 2012, I have tried to refinance my 1st and 2nd mortgage to take advantage of the lower rates. In doing so, I found a lender who would do the 1st mortgage; but due to LTV, we needed to subordinate the 2nd with Bank of America.
We started this process in mid-February 2012, and it is now April 4 and all I have been told by Bank of America was that my "subordination agreement" is in underwriting. All parties--broker, lender, title company and me--have satisfied every request made by the Bank of America underwriter, including an affidavit stating that I have never had to pay dues to an HOA. I guess the title states there was an HOA, when the house was built in 1987; and their underwriter needed proof I was paid in full. I told them I have never paid dues and questioned why the lender who was actually refinancing my 1st mortgage did not make this a condition from underwriting. And I have tried to remind them that this is merely a subordination agreement, not a refinance.
I have had (3) anonymous title companies look at my title and all three have eluded to Bank of America as a joke. There is no way that this $19,000 2nd mortgage should have taken this long to process and sign this subordination agreement, unless you are Bank of America. They are so large and out of touch with their customers that they do not care that every day they delay finalizing this agreement, it costs me money. All they want to do is hold their greedy hand out for the payment I have made on time since June 2005. What am I getting for this payment certainly is not customer service!

Bank of America sold my home at an auction during the process of a short sale. After twice declining their short sale program, BofA made me apply for the "traditional short sale" program several times. I began the short sale process in July 2011. After finally approving the short sale and having several offers on the home, BofA decided to auction the home. After learning of the auction, my agent contacted BofA; and they agreed to pull the property from the auction. The day following the auction, which occurred March 14, 2012, I got a visitor at my door stating he is the new owner of the property and wants me out immediately.

Both my husband and I lost our jobs, so we fell back on our mortgage. We never stop paying, but we're sending less money. We asked for help, and we were told to send bank statements, pay stubs, all types of financial paperwork. We send all this information via fax, email, and hard copy through FedEx; and they kept saying they never received it. Our home now is on foreclosure, and we have copies of all our payments. We got divorced because of the stress Bank of America put in our marriage.

I decided to refinance my home on Dec 7th. I spoke with Scott ** from Bank of America and he said "no problem, looks like you qualify. I have done this for years and you can trust BOA. I can send an appraiser out and it will cost $480.00 and you can put it on a credit card." So that part happened quickly. The appraiser came out within a week.
From that point on, it was down hill. I was directed to a gal named Cheri ** who was less than helpful. I would check in approximately every week and every two weeks they needed something different from the underwriter. This went on for 2 months. Then I was informed Cheri had made a mistake and they needed to resubmit my refinance. That was mid January. And again I had sent in more info. It was like begging for money. That brings me to this week, Monday, April 2nd. Cheri had said the following week you will be able to sign papers for your loan and it should be final. But no! On Monday, I was informed I need to get another appraisal and I would have to pay for it.
There are some cracks in my foundation and had been informed I would need an engineered system and I should have known about the cracks. Well yes, I did know they where there when I bought my home 11 years ago. There was still no insurance that I would get a refinance with a second appraisal. I used a choice of words. I had had enough. It had been 3 months of nothing but headache.
I have been a valued customer of BOA for several years and that is how they treat their customers. I have always paid my mortgage on time. I have a high credit rating, I work extremely hard for my money and this is how I am treated. It really is too bad that BOA is not willing to work with me.

In early 2011, I fell a bit behind on my payments due to the loss of job in 2010. My original mortgage was through Countrywide when I bought the house in 2004. My payments started at $939 and they are now $1175. In 2011, I called B of A to ask for help on my payments and was denied any repayment type of program. I sent in payments and they were returned to me. I was only 2 payments behind when I got a letter from their attorney stating I owed over $4K in fees, etc. That's is over $1600 in fees. I could not pay this and kept sending what I could but again always returned.
Finally, I contacted an attorney and filed bankruptcy and then in November started this loan mod process. I am experiencing exactly the same as everyone else's posts. I am on my second relationship manager, lost paperwork, etc. Because of this, BofA has now filed a foreclosure suit against me in the local court even though I have been in this hell of loan mod process for over 4 months. Yesterday, my relationship manager, Franklin, told me that he was no longer allowed to email me only discuss by phone. Really? Wow, it sounds like to me they have something they are hiding or do not want to be held accountable for. I cannot believe that our government is letting this company get away with all of this. I do not have a good feeling about any of this but I plan to forge ahead and if I must, I will sue Bof A.

They foreclosed on my house when I had short sold 5 different times. They would take so long to get back to the realtor the bidders bailed out. Then, when I switched to a different kind of short sale, they waited two extra weeks then they told it would be approved so they could sell the property at an auction. They approved me the same day of the auction and said they couldn't reverse it on the same day of the auction. I had a seller waiting to buy it. Is there any way I can seek restitution for them screwing up my credit. Now, I can't even buy a car much less a home. Not sure if the realtor wasn't in on it.

I applied for the Making Homes Affordable modification 10 months ago. I don't have room here to go through all of the phone calls and faxes I've sent since then. But the straw that broke the camel's back is that I finally got an approval for the program with a trial payment based on incorrect income information. I have called BofA several times in an effort to straighten this out, but to no avail.
BofA is showing my SS income as $2516.12, when it is only $2012.90. They admitted that my bank statements show the correct amount but said there was nothing they can do about it. One representative told me to go ahead and make the trial payment as outlined in the trial plan proposal (which I cannot afford).
The next day, a different representative told me not to make the trial payment, because if I fail to make subsequent payments, I would be disqualified from re-applying for the modification. Is there anyone out there who can tell me where to go (other than an attorney whom I simply cannot afford)? Besides, I've already been there. The shyster did nothing for me, except take my money. Please, someone, I need help!

For the past 3 months, I was trying to modify my home mortgage and have even paid a lawyer to modify my mortgage. I was assigned a customer relationship manager by the name of Martina ** with a letter informing me to call them so that they can discuss with me programs that are available. For the past 2 weeks, my representative and myself have left messages and a request for call back which up to know have not happened. Messages left to the immediate supervisor and the next supervisor got the same result, no calls whatsoever. I wanted to apply for the HARP 2 program and the calls keep getting routed with the same customer service manager who never returned my calls. What happened to the common courtesy of returning calls to customers? It's been very frustrating. I need to know my eligibility for the HARP 2 program and I don't know who I need to talk to or to apply when the people assigned to me never calls back.

Bank of America will not call me back! I have left several voice mails for multiple people in the loan modification department, but no one will return my call. I can't reach a live person unless I call the main number, but that person tells me they have to transfer me to the loan modification department, and when that happens, I'm required to but in my loan # or it doesn't let me continue. When I do, that's when I get transferred to my "relationship manager's" voice mail.
When I originally called in January though, I hadn't started the modification process yet so I was transferred to a live person. That person collected a lot of information from me to start the loan modification process. He said I was pre-approved and would be sending me a packet to complete and return with the necessary documentation. I still haven't received the packet! I've been calling for the last several weeks and am getting really frustrated.
Now, I've received notice that my property is scheduled to go to sheriff's auction. I lost my job last year and fell behind on my mortgage. I knew when I called in January it was in foreclosure but the man I talked to told me I could do a modification and save my home. Now, it looks like I am losing it after all. I just don't understand why they never sent the packet and now they won't call me back. How can I talk to a live person?

Promised refund not fully provided by BofA: Mr. Rick **, Bank of America loan officer, sold us into getting a home loan for a property that we were purchasing. Among the terms of the loan he offered to us was that BofA will refund to us the cost of credit report ($35) and appraisal fee ($595) at close of escrow. Our loan number is **. Escrow closed on January 27, 2012. However, the only credit we saw that could be for the appraisal and credit report fees is for the amount of $543.75. The expected credit is $630 ($35 plus $595). There is a short of $86.25.
On February 9, 2012, we informed Mr. ** as well as the escrow company of the short in the reimbursement amount made to us by BofA. After additional explanation provided to Mr. **, he agreed to the short of $86.25 that was not reimbursed to us by BofA. He repeatedly told us by emails (February 10, February 22, and March 12) that he is working to get us reimbursed. On March 12, he emailed that his manager is approving the reimbursement.
To this date, April 1, we have not heard from Mr. ** nor have received any indication that BofA is sending the $86.25 they owe us. We have given BofA enough time to work this out. We want BofA to send us, in this week of April 2, 2012, the $86.25 that they owe us.

This is my second time writing about Bank of America and their loan modification. After two years of not receiving paper work, not getting the paper work in before the deadline, re-applying for modification and needing more paper work faxed, I think I have spent about $600.00 in faxes alone--and it goes on and on. I could write for days about my personal nightmare with Bank of America.
The latest is I'm now on the second relationship service manager of the CEO's office even after they stated that I would only have one. Bina ** was the first. Of course, more documents to fax and never any phone calls back. She said three weeks ago that we were going to finally get an answer next week on modification. But two weeks went by and there was nothing.
Then, we got a letter saying that Darion ** is our new customer relationship manager. We tried calling but never called us back. Finally, on 3/29/2012, I was able to reach Darion ** and he said that he would need more paper work. It was the most recent mortgage statement for my income property that is also with Bank of America. I said, "You are the servicer of that loan, you should be able to pull that up right now on your computer." He said that they needed a copy faxed to them.
Well, after I got off the phone, I decided to call the 1-800 number on the most recent mortgage statement. I want to make sure that the loan is in no way connected with our main home loan. It should be just under my name as our main home is in my husband's name. They both have different account numbers. When I called, the automated voice said that I will be transferred to an account representative. And guess who answered? Darion **. I said, "How are you in charge of this loan? I'm not in default or asking for modification." Can anyone tell me how this works because Darion ** could not? Is there really a CEO's office with customer relationship managers? And what is a customer relationship manager anyway?

In December of 2011, Bank of America sold our loan to Greentree. To date, they have not forwarded our December payment. After 3 requests and several telephone calls, they can not locate the payment even after I have provided the documentation showing the payment cleared my account. They sent me a letter stating the payment was forwarded. However, to date, Greentree has not received it. A few calls ago, I was told that they have no record of the letter.

This bank approved a short sale on a property for the seller (I am a real estate broker). The comment from the negotiator at the bank at the end of February was that she needed to pass the file to their Jacksonville Office for final action. The person the file was transferred to refused to return calls and finally asked for all of the paperwork previously approved so that she could approve it. This happened 2 weeks ago, then again, no returned calls. We contacted her supervisor who stated that if this woman did not do her job on Tuesday, to call her and she would take care of the problem. Since there has been no action on the part of the first employee, now the supervisor is not returning calls.
This is not the way to assist in helping consumers to sell their homes when they are in a dire financial bind, especially by workers in the system whose jobs are based upon riding on the backs of these consumers.

For the better part of 4 years, my family and I have been trying to get assistance with our mortgage payment. We finally made the decision to do a short sale in hopes of eventually saving some money in the long run. In October 2011, an offer was put in on our property. Since then, we have been jumping through hoops for Bank of America to get a decision and a closing date. We were in the final stages of the sale when I was notified by my lawyer that Bank of America moved our file into a deed in lieu department because there was no offer. We were told that someone from Bank of America spoke with me personally on 3/28/2012 to confirm this. This is not true. I have not had contact with anyone at Bank of America since October 2012. When asked, the Bank of America representative could not give an explanation nor could he reference the call that had allegedly taken place. This mistreatment has gone on for four years and I can only imagine how many families this has happened to.

Bank of America has withdrawn (twice in a month) three times, which were unauthorized from my bank within one year. This has caused my bank account overdrawn and caused my family emotional and financial suffering, not to mention the penalties I had to pay to the bank and other creditors. I will like to have all three extra withdrawals with reason or without reason in writing to be sent to me.

I bought my home in 2005. I was so happy to purchase my first home—until I had to deal with home mortgage banks. The original loan was for a fixed interest rate and payments of $960 a month, which is very doable. But after 3 years, the bank found they made an error and increased my mortgage to $1320.00 without notice. I did a remodification loan and had to default on my payments for 3 months to qualify. The bank asked me to send them $3500.00 for the process fees of the modification. In 2010, modification was completed. There was no change in interest rate and no change in decreasing the payment.
I received a letter stating that the only change to the loan was an added $4300.00 for attorney’s fees added to my new mortgage loan. There was never an appraisal done to the home and the value of what the market value of homes in the area, so I tried a short sale for 11 months. The bank dragged their feet. And as the home market kept decreasing, so did the value of my home. They assigned a third-party collection agency (AMO Recoveries) to sell the home. On March 20, I received a FedEx package saying I had till 3/29/2012 to continue with the short sale or enter into the HAMP program. I called them and told them I wanted to take my home off the short sale market and try to save my home with HAMP. I called AMO Recoveries to further get details about the program and found out that the account with AMO was closed.
I notified BofA and within 24 hours the house is in foreclosure. America needs to get rid and shut down this nasty practice of cutting people’s lives into poverty for the profit of several dollars. As of today, I don’t know where I stand in trying to save my home. I was given a lawyer’s number about the home in foreclosure. I called them and they said no, the foreclosure was stopped in May 2011. So what is BofA achieving with not knowing what they are doing with people’s lives in America?

In April 2008, I signed on my third house buying experience with Bank of America. I wanted the taxes and insurance escrowed into the loan like all my other house buying experiences. I investigated several times after receiving my payment book that stated my payment was $550. I called the bank to make sure this payment was correct and was told on numerous occasions that the amount was correct. Then I received notices from the tax authority, school district, etc. that my taxes had not been paid for 2008 and 2009. I called the bank again and asked, "What was going on?" The individual on the line told me that my account has never been escrowed from the beginning. Oh, I was hot! I am now looking at trying to come up with almost $5,000. I made payment arrangements with the Harris County Tax Authority and made monthly payments for the year. I then found out that Bank of America turned around and paid them too. I was so upset at this point. I never have experienced such unprofessionalism in my life!
I received another payment book that my payment was $950 some dollars. That's double than what I had been paying! I got a letter in the mail from BAC that I requested of all transactions which involved the taxes. I looked at it and immediately called the tax department of BAC because they had charged me twice for taxes. The individual again apologized and fixed the problem, and sent me another payment book of $650. Okay, so I thought. I was finished with this ** to only learn that all this was costing me over a thousand dollars in late fees. I called several times to get this straightened out but with no avail. I fell behind one month in December of 2010. I called BAC in March 2011 to see if I could make partial payments towards that month and the response was no. They wanted the month plus the late fees from the mess before.
I called again in April, May and June. It was in June when I learned that BAC had put my house in foreclosure back in April of 2011. I never received a phone call nor a letter from BAC. I only received letters via Fed Ex about the late payment part and that's it. I know BAC owes me money from putting me into foreclosure and not telling me. If I had known this, I would have never kept calling, and kept making payments. In November 2011, I called BAC to see what I needed to do about the foreclosure to only learn that my house was going to be sold by auction on December 6th, 2011. It was at that moment I stopped total communication with them. I never in my life experienced this sort of scamming. It is scamming when BAC puts someone in foreclosure and never tells them. Can anyone help me with this?

I filed for a loan modification over a year ago. I received the information for a trial period of 3 months. Once the payment was paid on time, the documents I received said they would then send me papers to sign to have my new payment established for the rest of the loan. Needless to say, this was just a scam because no paperwork ever came and I have continue to make my trial payment as told by every rep for BAC that I talked to. I have not missed one payment. The other day when I came home from work, I received paperwork to start the entire program over again. I have already done it twice now. I just want to keep my home. I called the company and talked to Robert ** who said that I wasn't in a permanent loan mod. What Bank of America is doing is waiting until I fall behind and then foreclose on the property by saying, "Never mind about the loan mod. Just pay everything due now." I have never been so disgusted in my life with a company. It is a shame they are allowed to do this to a person. Their loan mods are just a bunch of ** just to hurt the home owner, definitely not to help.

I applied for Making Home Affordable in February 2011 and was denied in April for not being late on payments. I did not qualify for refinance due to owing more than the house is worth in the current market. Obama announced the new program for Freddie Mac and Fannie Mae loans that were under water in September 2011 and I applied right away. In December, I still hadn’t heard anything except every time I called, they tell me it was still in review and all paperwork had been submitted. In January, I received a letter from Bank of America stating within 20 days I should have an answer.
I called in February because I hadn’t heard anything. I kept leaving voice mails and not until I left a voice mail for the supervisor did I get a call back. That call said that I had to turn everything in again because it had been too long since I applied. Whose fault was that? Now, I call every week and maybe get through once every couple weeks. Since February I have turned in 3 applications, numerous rounds of bank statements, 2 letters of hardship and my signed tax forms from 2010 twice. And since one week ago, I have not been able to get through again! The worst part is because we claimed bankruptcy after they denied us in February 11, we cannot refinance anywhere else. I believe they know it and are stringing me along. The value of my house has dropped from $400000 to $208000 in 7 years.

I began working with BOA in December 2009 to modify my loan to a more affordable payment as a result of unemployment for 9 months and eventually resuming work in April 2010. I initially worked with NACA and was denied multiple times for a variety of reasons, each of which I addressed by nearly doubling my income, which then made me ineligible for assistance from NACA. Finally, I was contacted by BOA in May 2011 to come to one of their home events and was granted a trial modification. I made 5 payments under the trial plan before I was contacted by a BOA representative who said she was told to get my permanent modification completed. This was completed and I began payments under permanent modification in December 2011.
In January 2012, I received the mortgage interest statement for the 6 payments I made in 2011 and I filed my taxes. At the time, my permanent modification had not been finalized yet and my loan had not been brought current. This was finally done at the end of February and I received a corrected mortgage interest statement last weekend stating that my interest paid in 2011 was $0. At no point was I informed that my 2011 payments would not be eligible for deduction on my 2011 taxes, though there were a couple opportunities for them to do so. I contacted BOA and all the rep would say is she was sorry, but when they brought the loan current those payments were posted in 2012; so, therefore, those amounts would be on my 2012 mortgage interest statement.
Now, I'm stuck having to amend my return and owe my refunds back to the IRS and State Treasury and possibly have a tax burden in addition. It will all probably be less than $2000, but I don't have that kind of money laying around after being without income for 9 months as a single parent of 2 teens and only working at market rate for a year and a half now. I'm still digging out, but through no fault of my own I'm back in the hole. I can't believe it isn't illegal for BOA not to inform you of their process and its serious tax implications! It was bad enough that BOA stretched this modification process out for over a year after my income could've supported making payments on my mortgage. Now, their process is putting me at risk for being delinquent on my mortgage again or being in debt to tax authorities.

To all the previous people, I feel your pain and frustration. But there is hope! Due to not selling our first house for 18 months and we lost all equity and went to this home with a much higher monthly payment than anticipated. Then on top of it, BoA raised it $500 a month (escrow? No one could tell us). So in November of '08, we were among the first to get our info in to BoA for a loan modification. We kept calling them every 2 weeks and we were told to wait, then to wait for a negotiator, then that it was too long since our info had been sent in so they needed more.
Then they didn't have all the paperwork. We sent more. But still no response. I kept up fighting for 3 years with them. But when they kept an insurance check for $9,000 we sent in to property claims for signature (roof damage), they kept and applied to escrow. Not even applied to our premium! It was then I saw that BoA had no scruples. No intention of helping us! We tried over 3 years to get help from them, calling them and they never, never responded.
Now my husband with MS lost his job. We declared bankruptcy and wrote a new hardship letter. No response. So after hiring an attorney, we have asked BoA for our deed. We were originally Countrywide and sold to BoA. With that sale, there was no deed/title paperwork. And now we know that is why we couldn't get a loan mod. We are suing them and hope every other BoA customer do the same. If they can't prove they have your deed, they have no right to claim your property. They are such a horrendous company and need to be taken down. Sue them! Just ask for your title, especially if you were formerly with Countrywide! They will have to dismiss your mortgage loan. Don't let BoA ruin your life any longer! Take control!

I wrote a letter to Bank of America, requesting assistance with my home loan after I discovered that the company would not or did not accept a mortgage payment for July 2011 in October 2011. I received a letter from them which said that I might be eligible for a few of their programs that are designed to help homeowners who are having mortgage problems! Well, what a joke that is!
I continued to send payments of $1250.00 to them each month, and the checks were cashed and then returned to me because the amount was not enough to cover my mortgage! Each month, the same thing happened; and after that, all my checks were returned due to the same thing! Why in the world is this company allowed to continue with the pretense of helping their valued customers?
Since November 2011, I have received 6 FedEx packages which included loan modification applications! I've sent four of the same packages back to them, and each time, they have additional questions! I even met with a counselor on March 1, 2012 who helped me with the paperwork. And then I got a call from someone else who had questions about the application! Really, what are they doing behind those desks and computers!
I have faxed information and sent an email for which I received a reply that the counselor that I met with wouldn't be handling the paperwork and that the loan modification is not guaranteed! I haven't made a payment for February or March, because every month that I've sent payments to them, the checks are returned!
I purchased this house 15 years ago as a single parent who was also taking care of an elderly parent. (My mother passed away in December 2008, and her passing sent me into an emotional rollercoaster.) I continued to make my payments and even tried to increase the payments, and I had a check sent back to me because I had paid too much!
I have numerous hardships from 2010 to 2012, but I have tried to keep making the payments. Right now, I don't know what to do! The only thing that I can see my self doing is filing for bankruptcy! My credit is shot to hell now! Why hasn't our government made this company give account to their wrongdoings! Bank of America is more like the bank of thieves!

I applied for a modification through NACA in 2009. I have never made a late payment nor would I to qualify. Well needless to say, I never received a modification the entire 2 years my request sat out there with the Bank of America modification rep. Bank of America would receive my payments at the branch religiously on or before the 15th. Personal check scanned by the teller, however, they would apply it 7-14 days later resulting in a late fee that each month I had to call to have reversed. I received a flag on my credit report, thanks to them. I submitted my documentation and Bank of America stood firm with their decision. I was told that I made a payment late in April 2010 and two in October, November 2010. I have stamped checks proving they are at fault and made just as many phone calls to them.
Why is the public penalized because they have outdated systems? I pay you at the branch and since you send my check to the mortgage department, it's not applied until 7-14 days later (what part of the game is this?). Now I received the check, which I have not cashed. I went into the bank for clarification as to why it was sent and here I am, not satisfied at all with the answer. They should contact the credit bureau and have that removed from my report. They also paid my taxes on time and did not let the new company know, whom also paid them. Funny how they both use CoreLogic to make the payment and no one caught this, but I'm expected to pay Nationstar (new mortgage holder) additional escrow until the county sends them the refund. It's bad enough we can hardly save extra money and now I have to submit it to you for your mistake. There is seriously something wrong with the way consumers are getting shafted when we do what we're supposed to do.

Every time we make a Bank of America mortgage payment, a letter generates. It will usually state that the amount for the payment we submitted is insufficient. We called customer service and we were told that we are missing 3 months of payment. We searched for receipts and found one copy of a cashier’s check and we submitted the copy to payment research dept. We were told that we will receive credit in the amount of $2,405.77. Now, we need to search for the two receipts. Because we are under a modification, we cannot sign up for automatic payments. Yes, we have made late payments, but never skipped a payment even when it was as high as $4,600.00 a month. We are experiencing hardship after my father pasted away. I feel angry because it seems that instead of helping to reverse the damage that Countrywide committed, that Bank of America is trying to swindle more and more money from us, and is causing so much unnecessary stress for my family.

I am applying for a loan modification and Bank of America requested a copy of the death certificate for the deceased borrower on the loan. The catch is, I am alive and the only borrower on my loan, basically making it impossible to get a loan modification with the bank. I made a video about it. Then, they called me.

We have been in communication with B of A since we got into trouble with paying our mortgage. Long story short, we have a buyer and had to come down on our price approximately $50,000 to sell rather than foreclosure. There was approximately $300 left to close on the deal and B of A would not budge off of any of their charges. The second lien holder is taking the hit to get this property sold. B of A stated there's nothing they could do. So basically B of A is full of crap, to put it nicely! Question: would you not think that selling at a good price and not going through the foreclosure process would be a better deal? No, they would not budge or give any relief on what was owed. All came down to the buyer and agent. I will never, ever deal with B of A again in my lifetime!

Help! Bank of America is wrongly foreclosing on my home. Please help.
For the past two years, I have continued to provide B of A with proof of home owner’s insurance. I have had my Farmer’s agent fax at least five times letters of experience directly from Farmer’s website. I have contacted the insurance commissioners, Balboa Insurance, the insurance company owned by Bank of America, and furnished declaration pages for the same policy same number that I have and have always maintained. Three weeks ago, I was contacted by Eric **, an account manager for Bank of America. He informed me that my home was in foreclosure and that I was at least four months behind. Wow, I said, but I have not at anytime missed four consecutive payments.
After numerous calls, it is clear that Bank of America continued to bill me for insurance even after they had proof that the property was insured payments where never applied to my mortgage, but instead placed in escrow and applied to forced placed insurance. Although, I have never revived a written notification, my account was credited for almost all of these payments that were erroneously credited to escrow. But any payments that I try to make are being returned and I can't get anyone to help me. The fact that I have an account manager is a disadvantage because he is rarely available and no one will talk to me or transfer me without him on a conference call. And to make matters worse, I have back taxes and because of the foreclosure the bank has paid my taxes and added that to the tab.
However, I am only two months behind only because they won't accept my payment and can really foreclose for back taxes. My seven children and three grandchildren live in this house and I work as a child care provider from home. To lose my home would be to lose my job. Foreclosure is a result of non-payment; I paid and they took my money and misapplied it. Somehow this just can't be legal. Pay mortgage first and anything else is secondary. No one returns calls. It’s a set up. The last person I talked to was Charlitha **. She said she would respond by Friday. No such luck. Eric said he would call. There’s no call.
I can't lose my home. Over the past two weeks, I have been diagnosed with high blood pressure. I can't sleep. I have a constant stomachache. Yesterday, they added Ativan to my medications—chest pain all for what. Please help. Please.

My home loan was always paid on time, yet one payment way back in October 2009 was put God knows where and it took me a year to have someone at the bank, seriously, resolve the issue. Meanwhile, I was listed as 30 days late for a year until I pushed to have it resolved. I had proof that I had paid it. Now, we come to the good part. Again, all payments were paid, and then my son died in November 2010. I had to use both November and December’s mortgage payments for his cremation and moving his items back home. I was in touch with the bank and I feel they didn't believe me, until I finally sent the death certificate. Then I had 3 months of modified payments where late fees were not to be applied. Then I resumed regular payments.
At this point, I was in touch with the program Keep Your Home California, who finally took the loan and paid all back fees and brought my mortgage up to date. B of A falsified to them in a letter, which I have, that I owed for January 2011. No, I had paid that month. Then, right after the program was done, all of a sudden I was $1,900 in arrears. Seriously? I have made the monthly payments since then, but in emails this has not been resolved. I refuse to answer their 5 calls per day because you have to tell them the same thing over and over. They are idiots.
Now, for some other news: my tax bill has been lowered as I have proven to the County Tax Board that my house is not worth what they were basing my taxes on. Did B of A get this memo? Of course not! They now have billed me over $200 more per month. To top it off, I just had someone come to the house to "check" if I was still living here and the bank will charge me $35.00 for this "service," which I will refuse to pay. Even the gal who came here said that B of A is a nightmare. So what to do now? Suggestions? Thanks!
Oh, wait! One more thing: months ago they had sent me documents to sign, under the guise of the company sending them, that they were here to help the homeowner fix the problem. False! This company was a collection company hired by the bank and they present themselves as a company who will help the homeowner with their problem. It is a company designed to get the docs signed and to help speed up the foreclosure process for the bank. Very devious.

I have submitted my necessary paperwork five times to Bank of America to modify my mortgage. Each time, no one responds until around six months. Then they asked me to re-submit the documentation again because it is no longer up to date. M. ** told me that she could not give me a name to call in underwriting, who she says is requesting this information for the sixth time. I am feeling that this is a ploy by them to put off the modification. It makes no sense. I could modify my loan because now I am doing much better financially, but they keep putting me through this cycle. I have several other friends who had the exact same thing happen to them. Is there anyone at Bank of America managing this process?

I am so disgusted with BofA's handling of payments. I sent a check for my payment. I put $1250 in the numericals but wrote out one thousand fifty. They cashed my check for $1050 (I meant it to be $1250.). They kept my money for a month with no notice of the mistake. Then they sent me a check exactly one month later for $1050, stating they could not accept a partial payment. So I am now one month behind. Why cash the check if it's short? Why keep my money for a month? Why send it back? I could go on and on. This is just ridiculous.

My husband and I have our home that was purchased in 2005 with Countrywide as our lender and now with BOA as our servicer, and Wells Fargo as our investor. I don't know where to start other than we have been trying to get a loan modification on our primary mortgage, but no one can help us because we are not in foreclosure and we are not more than 2 months behind. But now I just found out we are just over $9000.00 behind on the mortgage. We have an 80/20 mortgage, which in the beginning was adjustable rate with the 80 primary and I was able to get Countrywide Mortgage to put it into a fixed rate for the remaining life of the loan, but just found out they also put another 15 years onto the loan. Now, it's in a 45-year mortgage. The only thing Bank of America has been able to do for us is:
b) Add the escrow on to the loan (we paid our own property taxes and homeowners insurance)
c) Add the so-called $9000.00 to the back of the mortgage (which I don't believe is correct)
I was told by BOA that we don't qualify for the HAMP since our mortgage payments are not 31% of our income and at one point, I was given a call saying they can drop the interest from 7.2% to 5%, which was great but the next week, I received a phone call saying the investor (Wells Fargo) did not approve it. I am so frustrated with all the time and effort I am putting into this as far as trying to get some help and feel like if we don't go into foreclosure, we will not get any help at all. I have even contacted the New Hampshire Senate's office and I can not get anything done there as well.
My husband and I are hardworking people and with the hardship of losing $200.00 a week from my place of business in January of 2010, we tried to adjust for a year and found it to be very hard and just asking for assistance in reducing the mortgage as I don't want to sell my home and will not sell it if at all possible. I keep getting the answer that on paper it shows we have enough income to pay our mortgage with sufficient amount left over to pay for the 2nd mortgage and everything else. I don't understand how they can figure it out other than they are not including the taxes and medical insurance that is being deducted from our pay each week. If that wasn't being deducted, then maybe I would say yes we can do it.
Our income in 2009 gross was $110,379 2010, $111,1123 and 2011, $102,000. So in 2011, we made almost $10,000 less than in previous years. The government wants to help keep people in their homes, then why can't we get the help we need?

I applied for a traditional, 30 fixed mortgage loan, in September 2006. I fully documented my income of $59k per year. Approved for $360k loan. I purchased a home on December 2007. I applied to refinance in October of 2008, every payment was early up until then. I was denied, which prevented me from moving forward with my life and my plans. Debt to income was too high. Well, why wasn't it too high when I purchased the home? At least two years later, a successful HAMP and now, the loan is still 37.5% of my gross income. I am expected to work another 14 months a total of 6 years just to end up with my original loan amount.
I was originally denied the loan but because I called, asking isn't it more important what I am making in the future? So somehow, someway, the loan was approved. I was told by a rep that I asked for it! I would have preferred an explanation as to why I couldn't afford it, not have my life ruined, to teach me a lesson. BOA should all go to jail. Have you seen their HQ building? It looks like Hitler's pad.

I got my loan modification on my first loan and then after one year finally, I got approved for a modification on my second loan. I finished my trial payments then my account manager tells me that no I have not been approved and I have to submit my papers and application again. I had been calling the bank since 12/2011 and it took two months before anyone was able to return my call. I feel I got misled and every time I would call, the client services would say, "No, everything is okay. Just make your payments and it will be resolved at the end." I have all my documentations to prove. I need justice and closure to this madness. Please someone contact me to discuss.

Because our modification was completed in Feb 2012, BOA reversed every payment for 2011 and did an accounting entry in 2012, which resulted in our 1098 being $0.00. This is after we had already received three other 1098 forms. I have called them numerous times to get this corrected, but they say there is nothing to be done and we will get double the interest next year. Big ** deal. I called after the third 1098 to make sure it was the last and final one, and was told yes it was. The taxes were filed and then the fourth 1098 came. Can you believe it was $0.00? There was not one missed payment for the entire year so I know there was in fact interest paid in 2011. Really, do you think any bank is going to give you free interest for a whole year? This is falsified information to the IRS. So now they want us to amend our tax filings. All this and it took over two years for the modification to be completed. Bank of America is a sham.

My loan is backed by Fannie and 40% underwater. With the new HAMP (Home Affordable Modification Program) law, I should be able to refinance at a better rate, but Bank of America sold off my loan in November 2011 to a company called Green Tree Servicing, and unfortunately Green Tree Servicing is not licensed in my city. So now I'm stuck without the ability to refinance, since no other banks are refinancing new customers. Even Bank of America is only dealing with current mortgage customers! It appears that Bank of America has planned the selling off of loans prior to HAMP 2.0 being released to reduce the number of mortgages that they will refinance.

Since sending them my paperwork for a loan modification, it has been lost numerous times. I have had about 4 different people assigned to my case. Each time a new person takes over, there is never any paperwork.

I recently lost my job, applied for Keep Your Home California, met all requirements and was approved pending BOA's (Bank of America) approval. I received an email and letter from Keep Your Home California stating that BOA denied us. I contacted BOA for a reason, but BOA said that KYHC (Keep Your Home California) denied us and that BOA would place us in another program of their choice.
I cannot get answers from BOA, so contacted HUD who has initiated an investigation. Three months have passed, now I'm in danger of foreclosure, because of ineptitude on BOA, or a conspiracy on BOA's part to stick us in a loan of their choice, when all we wanted was to use the Keep Your Home California program for which we were eligible for and would have kept us current on our mortgage to give me time to find another job.
Now we may be foreclosed on or have to short sale our house. We have been trying to work with BOA over the past few months to no avail, always getting a different story, never getting paperwork or call backs. I am a combat veteran, who lost his job because of a plant closure and I should be the one to get help, but all we are getting is the run-around, in order for BOA to take our house. I don't know where to turn.

My home was to be sold on a HAFA short sale, which enabled me to receive $3,000 to help relocate. After the sale was closed, I found out that the sale was changed to a regular short sale and no relocation money was to be given. I was never notified that the terms had changed. I kept my end of the agreement and stayed in the house and ended up moving at Christmas! Bank of America are lying, cheating thieves!

Still trying to close on a house. We are now up and over 60 days of escrow. We were supposed to close at the end of February 2012. We've constantly been given the runaround on this. We've been told again and again that they need documents they've been given over and over. The owner of the home has had to come out of his way to sign three extensions for us. He won't be doing it again and we have less than a week to close or we lose this home. I am just heartsick over this whole mess. Steve ** who works for the CEO's office, supposedly saw another rant of mine on here and said he would get this done and rushed for us. We still have yet to see the end. We've had to move out of our apartment because of the 30 days notice, so we currently have all our belongings on the side of my mom and dad's house, out in the rain.
We have a 4-year old who doesn't understand what is going on. We are homeless, having to live with my mom and dad until this is all resolved. It's a nightmare. We paid for the rent certificate that cost us $1200 that we really can't afford just to get this closed. Crooks! I bet they keep it too, should this not come out in our favor. I smell a lawsuit that shouldn't have to happen! We are preparing to take legal action. They say they have everything they need, again, for the dozenth time and said we should be good to go. Then we were just told that we need to get a pest inspection done and it was done already! This is just beyond ridiculous. I have names and all the PDFs we have sent back and forth to these **! I am tired of being nice and not getting anywhere. Crooks! Horrible customer service, horrible, horrible company.
When this falls through, we will be taking our banking elsewhere and I will see to it that everyone I know who banks with BOA does the same! Debra **, Robert **, Shannon ** and Steve ** are the ones supposedly "on top of things" and "rushing it". Full of crap! These people should be hanged for what they do to people. I really hope they pull through like they promised over and over. Again and again. Unbelievable and beyond ridiculous! Don't bank with BOA or do any business with them. They are crooks and have no idea what they are doing, messing with people's lives. This is the worst thing I have ever been through in my life!

I am 4 months ahead on mortgage payments and 1 month ahead on PMI. This year, in contrast to prior years, BOA projects a PMI shortage by assuming I will make no more payments until P&I required. Payment history shows that has never been the case. Also, I make additional principal payments. BOA is stealing some of that money and applying it to a non-existent escrow account. They have also changed rules for eliminating PMI. Only documents I've signed and their info A/O 1/13/10, shows no PMI when principal balance reaches 80% of original property value. Since 2007, I have been in a constant battle with BOA to stay in my home. They supposedly granted a proprietary loan modification in 2009, could not find paperwork in their system, scanned my copies of the loan modification and finally notarized them in March 2011. The first statement I received under loan modification already showed me being $5,000.00 in arrears. Payments were not applied correctly and it goes on and on.
I am now in foreclosure and my lawyer could not seem to understand. The local court system, the "good old boys," feel that the bottom line is--"You didn't pay your mortgage regardless of the circumstances. BOA has grounds to foreclose." I've gone broke trying to keep my home and paying attorney fees. My credit has been ruined and I can't even find anyone to even loan me a dime--not to mention a refinance on my home just to get away from BOA.
FYI, my mortgage started off great with Countrywide. We had good credit, good rate, great income and then nothing. My husband became ill, got hospitalized, fired by his employer while in the hospital, lost medical insurance, lost life insurance and his life on 11/7/2007. We were responsible homeowners, not dead beats. Luckily, for me, the surviving spouse with no children, is that I have been gainfully employed this entire time as a nurse practitioner with a Masters in Nursing.

Bank of America Home remod - As I read this, I'm glad we are not the only ones. Two plus years of being jerked around by BOA, we finally hired an attorney. I can’t say anything that hasn't been said on this board. It's a true disgrace what BOA is doing to the people. And how does the government allow them to get away with it? More tension to add to the house than needed when trying to raise a family.

In July of 2008, I lost my job and was unable to stay current on my mortgage payments. At that time, I was a single mother of 4 collecting unemployment with a mortgage payment around $1,600 a month. I maintained paying $1,600 as long as I could to keep my family in my home. In 2009, my payment jumped to $2,000 a month, making it harder to keep up on payments. In April of 2009, I applied for an in house modification with First Franklin Loan services (my lender at the time). Up until this point, I was able to make my payment. I was denied the modification because my only income was unemployment. By the end of 2009, my payment was $2,200 a month, near impossible for me to maintain.
In October of 2009, I applied again and qualified for a forbearance program. I was able to pay half my mortgage payment for 6 months but unaware of the fact that the other half was adding up in a past due amount. The program was not completely explained to me. In October of 2009, Bank of America bought my mortgage from First Franklin and my mortgage is currently still with Bank of America with a monthly mortgage of $2,575 a month and a 7.95% interest rate. I was told to apply again for a loan modification.
In March of 2010, I applied again as instructed by Bank of America. In the transition from First Franklin to Bank of America, no one seemed to be on the same page and I could never get answers from any bank employees and when I did, it was always something different than what I was told the time before. I was really concerned as well as very frustrated with the situation.
In May of 2010, I was told that my paperwork had expired while in possession of Bank of America. I am not even sure how this is possible. Now, I am making partial payments, figuring it is better than nothing. Apparently, this is not the case. Bank of America was applying my partial payments into an unapplied funds or suspense account and it took me months to get them to apply it to my past due mortgage. In May, I applied yet again for the modification.
In July of 2010, I was denied again and was told to try applying for the Making Homes Affordable modification. In August of 2010, I applied for the Making Homes Affordable Modification while collecting unemployment and was denied once again. In August of 2010, my unemployment had ended and I was running out of options. In this time, I had gotten married and now my husband move into the house with me and my kids.
In September of 2010, I had my husband write a contribution letter stating that his pay was going to be used for the mortgage payment since his name was not on the mortgage. I applied again for the Making Homes Affordable program. I received a letter from Bank of America congratulating me on my first step in the modification and that I would be notified in 30 days of my status. The 30 days came and went, I heard nothing. I called Bank of America weekly to find out my status. I was told each time I called that my modification was in Phase 1 and I would be notified in 10 days.
In April of 2011, I called Bank of America to find out the status of my modification and inform them that I had started working. I was told to fax over 2 recent pay stubs. I faxed my pay stubs to Bank of America on April 7th. A few weeks went by and I started calling again. Now I am being told my modification was in Phase 2, finally seeing light at the end of the tunnel. Another month of calling and getting the standard answer, “Your modification is in Phase 2.” During the 2 years this modification process is going on, I am receiving letters and phone calls from Bank of America, not to notify me of my status, but suggesting I apply for a modification. I was already in the middle of one!
In July of 2011 on a follow-up call to Bank of America, to my surprise, I was told my modification had been denied once again. I asked the agent the reason for the denial and she continued to tell me it was because of the change in my income. I told her when I called and notified the bank of this change, I was told to fax in 2 pay stubs. I asked if she could explain the reason for faxing my pay stubs if the modification is denied and I have to start over because of this change. She could not give me an answer. I then asked when Bank of America was planning on notifying me that my modification was denied. She said that I had already been notified, not in writing but by a message left for me. When I say message, I mean an automated recording that is automatically cut off when it goes to an answering machine and never once does the message state that it is Bank of America calling regarding my loan! I feel Bank of America should have sent something in writing. Perhaps by certified mail or a phone call by a person, rather than a recorded message.
In November, I went to the Bank of America Assistance Center in Chicago. I filled out every form they could possibly need and then some. For the past 3 months, I have been told I am in Phase 3 and my modification should go any day now. I was notified yesterday that once again my paperwork has expired and is older than 90 days. I have to start over once again. This will be my 10th time filing for the modification and 3 years of getting the run around from the bank!

My husband and I have been dealing with pretty much what everyone else has on this site for over 6 years (first couple of years were with Countrywide and then escalated to BofA). We were handed over to Countrywide back in 2006 when I lost my job and couldn't afford our payments. We were at an outrageous ARM rate and the rate was due to increase top 10.12% December 2010. We decided to contact BofA to see if we could get modified. We did in September 2010 with a fixed rate of 8.875% and when we argued with them that was still too high, they said we either pay them the modification installment or be foreclosed. To this day I wish we would have foreclosed.
After the modification, we noticed we were a month behind from the start. After calling BofA, they stated it would take 60 days for them to adjust our account from the ARM to the fixed rate (which took place in October of them fixing the account), but had only given us 10 days to hand over our money and once they put everything through, we were still showing a month behind. At this point we started to refuse to make payments until this was fixed. They told us we owed them the money and that was that. I called them every week from October 2010 until May 2011 (making payments when we could) until I spoke to a supervisor who saw the error.
We were four months behind according to them at this point and once the account was fixed, we were only two months. We talked to them about getting modified again and to pay off slowly the two months we were behind to catch up. We went to make the first catch up payment and it was rejected and we were told we were four months behind yet on our mortgage that we had to pay, or else foreclosure proceedings would persist.
Long story short, we could no longer make payments and fell into default all the while working with a supposed mortgage counselor (3 to be exact) and spent numerous hours and months to apply until we received our last denial letter stating we were denied a modification due to insufficient paperwork. This was after the counselor told us everything looked great! Were were then served our court papers 2 days after Christmas (2011) and are in the process of being foreclosed on. We have hired an attorney, had meeting with modification counselors (who say we may not be eligible for a modification because we already had one in 2010), so at this point my husband and I are letting our attorney handle everything.
All of their so-called workout programs are a fraud (attorney has even confirmed that with us). Why does the government keep bailing these idiots out and killing the Americans with their hard earned dollar? Because they own BofA and can do whatever the heck they want and kill the American dream of homeownership, all to keep their pensions and money intact for themselves.

First of all, I would like to say how unprofessional your entire organization is. I started a refinance process with Bank of America mortgage 90 days ago. I was just declined for having an unfavorable debt to income ratio. The process took way too long. The same documents were requested two or three times. I don't think anyone even looked at them for 60 days. I told Dane I had additional income at the outset with two more annuities for life, which he said should not be necessary. Additionally, I explained on my company's P&L that much of the debt I had was for buying out some of my agents’ future income, which was expensed for 2011. I don't think they looked at that either.
The document people took up way too much time with our condo association board member, telling them that we must have a street maintenance agreement, because we are responsible for our street. Yes, she sent our by-laws, which stated that we were responsible for the street. The document people continued to press for a street agreement, which we do not have. That’s crazy! I will save this as a draft, and keep sending to the higher ups in Bank of America. No wonder the bank has to pay hundreds of millions in repossession fines, as there are so many inept people there.

Our house insurance has always been paid out of escrow. One year, we received a notice that Bank of America was attaching its own insurance because ours had been cancelled the year before! We never received any notice of this from our carrier or the bank until they attached their own insurance. They claimed they paid our home insurance from escrow. The money was definitely gone, but the carrier said they never received.
For years, we have written letters and spent hours on calls trying to get this fixed. So, they are charging us for the year they lost and a whole new year we already paid out of pocket. They put most of my payment into a shorted escrow. They essentially stole money from us and will not do a ** thing about it! They are still stealing every month to replace an escrow shortage they created.

More than a month ago, I applied the HARP loan refinancing from Bank of America through the phone. I was told no appraisal is required for this type of loan and that it should get approved since our mortgage is from Bank of America, and that my husband and I have great credit score (795). We have 2 loans for this mortgage. Bank of America told us that our smaller loan from the other bank does not approve, so the refinancing did not go through. Bank of America charged a fee of $470 from our credit card. I tried contacting the loan officer to ask him that the fee should not be charged since the loan did not go through, but he didn't reply until a half month later.
He finally did and said that the fee is from outside, and that nothing he can do about it. I emailed his manager and she said that if the appraisal went through, then the fee is non-refundable. I just want my $470 refund back since the loan did not go through. This fee was supposed to be included with the mortgage when the loan is approved and also part of the package (with closing cost). Can I get an explanation from this issue?

BofA sold my conventional mortgage to Fannie Mae and now I don't qualify for the newest refinancing relief. You see, Fannie Mae isn't participating in that. I'm slightly underwater, up to date on my payments, good credit. If BofA still owned my mortgage, I'd qualify. That's the last straw. I'm closing all my BofA accounts and I'll take the mortgage from them as well ASAP.

I became disabled in 2009, losing my job and my life shortly thereafter. I have not worked since 2009 and have been unable to pay the mortgage payments on my home since July 2009, almost 35 months behind. I went through a divorce and expecting the home to be foreclosed upon found myself meager living in a small apartment before my credit was wrecked and I would be unable to get a rental and be homeless! My ex-wife has been unemployed for over 14 months in the last 36 months and will soon be out of work again, trying to support our 6 year old daughter. No-one has lived in the home since July 2009.
I have tried short sale, deed in lieu etc. but everything failed. Banks were too greedy and would not accept any of the offers without also having us give them our entire $401K savings (which we did not). I keep calling them and they tell me that my home has not met the criteria for a foreclosure review? Seriously?! An empty home without a single payment for almost 3 years and they don't feel it's necessary to foreclose?
I am getting very suspicious of their reasoning and have on many occasions asked to be put through to the department who makes such decision for a home to meet foreclosure review guidelines, but of course, they don't know any contact numbers or people to talk with! Lies and more lies! If a department exists within a company, there is a way to get in touch with it. Can anyone give me some advice as I am highly suspicious of Bank of America and not quite sure why they want to delay the foreclosure. Thanks!

Bank of America is the worst bank in the history of mankind. I have been trying to short sale my condo for the last 2 years due to financial difficulties and every time an offer comes through they reject it for some reason. The first offer was about one and half years ago and it was for about $140k. They rejected it. I had three other offers for less than $140k and they rejected it. Now, the last offer was for $83k. They are pushing me toward foreclosure. The last time I was on the phone with them, I had to stay on the line for 45 minutes and at the end I was disconnected and did not get my answer. I thought someone watching over the banks and how they are dealing with their customers.

I also was a Countrywide customer that BOA took over. When the Make Your Home Affordable Program first came out, I called to see if I qualified for a modification since I was so upside down. They looked up my loan and told me they can modify my loan and drop my payment by several hundred dollars per month. I was thrilled at the moment. They stated they needed $500.00 on a credit card and would not even need an appraisal! I gave them the $500.00 and then I was called and told a closing date and someone would come to my home and close the loan.
The day before the loan closing was scheduled, I was called from BOA and was told I needed $5,000.00 to cover taxes and insurance escrows! I was shocked since I was never told that and then begged and borrowed to get the money since the modification was going to help. The attorney then came to my home to do the closing and my husband’s name was missing from the paperwork since he was supposed to be on the deed. After an hour of signing documents, the attorney left. Once I was ready to do my taxes, I took out the loan documents and noticed they added over $10,000 to my principal to close the loan! What kind of modification is that?
I called BOA and told them I was unable to afford the loan and I needed a modification, they told me I do not qualify since I refinanced with them after 2009. I explained to them that I was not told it was a refinance and they charged more to my principal since it was a streamlined refinance. I was not told any of this. I am now so upside down in my mortgage just barely affording the payments. My husband is now laid off and his name never even ended up on the deed. I feel like I was taken advantage of by the bank and ripped off!

I have been trying to resolve a problem since March 2011 when I paid closer attention to my Home Equity Loan. The terms of the loan upon inception, when I initially signed the documentation loan, I agreed to the monthly interest only for payment to be automatically deducted from my Bank of America checking account. Please note that I am trying diligently to pay off this loan. B of A sends a monthly statement and at the bottom of that statement is a tear off payment slip for a "principal only" payment. The terms are automatic deduction of the variable interest amount. When I called in during March and explained my problem, the customer service person (who they can identify) sent me an account analysis from 5/28/08 through 3/17/11. She said "they do that sometimes". They continue to inappropriately manage this account. Today, I called in and held and spoke with a CS person for 31 minutes and 43 seconds and she finally essentially said: "If you mail your principal only payment after the first of each month, then there shouldn't be a problem.”
She also said it’s not necessarily my fault. Okay. I inquired if there is any mention of a principal payment needing to be received after the first of the month in the original paperwork that I signed for the loan. Answer: no. I asked: Did the person who completed the application process with me have the knowledge and obligation to verbally inform me of this since it was not communicated in any way by the B of A employee who processed my initial loan? Further, should the CS person I called at B of A who sent me the analysis on 4/12/11 be obligated to inform me of the first of the month date? At any step of the way, this could have been corrected if the employees at Bank of America had been trained properly or followed process and procedures (if they have them). This is the fault of the bank and the employees. I do not think the branch CS person nor the person who issued the account summary are knowledgeable of this issue "rule".
Today, I went all through it again. I had made a $1200 principal only payment on 2/29/12, which is after the first of the month coincidentally and they still screwed it up. I asked for another account analysis and indicated that they are liable for the interest out/principal that they incorrectly applied to my account. They actually backed out my payment and deducted it from the principal payment. It was before the first but their new excuse is they thought since it was close to the first of the month, they would just process it the way they wanted. Okay, once again, you can't have it any way that you care to screw over a customer. A long standing customer, I might add. The payment research department said they would correct just this last month’s error and the rest is screw me. They misappropriated my payments since the inception of this loan. B of A needs to do what is right according to legitimate banking processes. The whim of apathetic, improperly trained employees should not be allowed to financially impact a customer and then say screw you.
I have a summary statement of my accumulative payment history from 5/28/08 through 3/14/12 (I can provide only 3-4 pages) and recommend that B of A corrects the errors and credits my principal balance with the money they inappropriately used for interest. I requested an interest rate sheet for accuracy for each year. I signed a contract with B of A that clearly states my principal only payment will come out of my checking account. No exceptions. Please help me. I am disabled, on a fixed income and am dedicated to my financial responsibilities. This is unfair. This is a continuing banking error. Lastly, every "principal only" payment I made I took a yellow highlighter to the line that said "Principal Only.” Not only are they arbitrarily ignorant, they also disregard a bright neon yellow marker. I can only take so much anxiety. Please help right this on-going wrong. Thank you in advance for your consideration. Best regards.

I requested a loan modification through the "Make Homes Affordable Program" in August 2011 due to hardship after divorce to reduce my monthly mortgage payments. The initial process included submission of the application and various items such as pay stubs, electric bill, bank statements, etc.
After 6 months, I still have not been approved for the program. Every 3-4 weeks, I am contacted by a representative requesting the same paperwork that was initially submitted. Over and over again, the same information is requested. I have asked to speak with the representative’s boss or someone in a higher position and I'm told "there is no one in a higher position. I am the only person who can help you." Hello? So again, for the 15th time, I will send the entire application and contents in again so they will have the "most up to date information".
I know someone who tried to qualify for the modification program and has since lost their home to foreclosure because they could not make the payments. Had Bank of America processed the paperwork the first time received, maybe they would still have their home for their 3 children to grow up in.

Our mortgage was sold to Bank of America and after that sale, my husband was laid off work for 13 months. In July 2011, we contacted BoA because we knew we wouldn't be able to make our payments and asked about a loan modification. They told us what to send and where to fax it to and within days, we faxed all requested information. In August 2011, we were told we needed to fax more paperwork and did it within days of their request. In the meantime, we would call to speak to someone and would never get a call back. After finally speaking with someone, we were told they needed more paperwork. We sent that as well. Late August, we received a call (shocked they actually contacted us) saying they needed 2010 tax statements. We already sent them in July but whatever so we sent them again. After numerous phone calls to our loan officer and always having to leave messages to no return call back for weeks on end, we finally were told they needed my husband's unemployment records, even though we had already sent that.
And in the meantime, he had gotten another job and they needed those pay stubs. We sent it yet again within days. On October 6, they said they needed more pay stubs so we sent them. In between all these times, we were told that our information was with the underwriters and we should know something soon. Then we we would call back to check and finally getting a hold of our loan officer, she would request more paperwork and we would send it. At one point, we were told that it had been kicked out because we didn't send all that was asked for! We would send stuff again. Finally after having to call supervisors upon supervisors, we heard from our loan officer last night, March 13, and was told to send most recent pay stubs and to fill out a form from the Making Homes Affordable government's site. This is all a huge runaround and while I don't want to lose my home, I am about to walk away and rent someplace. It's just not worth it anymore. They say owning a home is the American Dream but it's more like a nightmare, especially if you have to deal with Bank of America.

In December 2011, I contacted Bank of America to pay my mortgage payment for December. I was in South Carolina visiting my father, who was gravely ill. While on the phone with the BOA representative, I suggested we make arrangements to pay January 2012 payment also because I had a lot of personal circumstances that were distracting me and I did not want to forget to pay January's. The representative said she would do so. She stated both the amount for December's payment and then stated the amount for January's payment. We confirmed everything and I thought that was the end of it.
In February 2012, I went online to make my February payment, only to discover that my account was stating that I had not paid my January payment. I called BOA and spoke to a representative, who realized that my payment made to BOA for January had been applied to my principal. I told her that is not what it was for, explained the situation and we went through the steps to correct it. While on the phone, she asked if I would like to now pay my February payment, since she had notated my account and had made the correction to my account. I said I would like to do that because that had been my initial intent when I had logged on to my account and had seen that BOA had made an error. Next, she took my banking info (of which I currently had a balance of $31,000) and she gave me a confirmation number. She had me void a check in my check book and told me I needed to call back tomorrow, just to inform the department that the $55 late free accrued in January would be applied to February instead. I did not understand it, but she said not to worry and she would provide that information in my notes so that anyone I spoke to would understand.
Tonight (two weeks later), I got online to pay my March payment and noticed that BOA has notated that I have not paid my February account! I called BOA and explained the whole situation again! Explaining that they failed to process my payment so I don't want a mark or foreclosure procedure to begin; considering in 7 years, I have always paid my mortgage payments. The representative could see that some sort of notation had been made to my account, but that nothing had been processed for payment. I gave him the confirmation number that the original rep gave him and he said it didn't match their "code" of confirmation numbers. Online, my account was noting that BOA and its affiliates were making arrangements for proceedings and I asked that since this was obviously BOA's mistake, that I wanted to be assured in writing that no proceeding would continue and that they would contact the credit bureau of their mistake.
He said he couldn't guarantee that. I said, I am in good faith and that I have currently have over $30000 in the bank and that I would pay all the way up to April in order for BOA to offer a certified correction letter to me and to the credit bureau and offer me an apology. He said he could apologize, but could not guarantee anything regarding my credit or the actions of BOA. Even though he apologized and did state that it was an error on their part, both in December and in February, he made reference to some "glitch" in the system on that day (February 29th). What can I do? Isn't this misappropriation of funds in December thus, causing a domino effect with me being the one effected? Any help would be appreciated.
