I had several short sale offers from 2008-2010 and none were accepted by Bank of America. Terry ** was the bankruptcy attorney and I surrendered the property as part of BK7. I was not informed that I was still liable for association fees. On 2012, I hired an attorney to fight the case for $1,667, which we lost. I am now looking at over $4,652.86 as final judgement against me. This is a direct result of the bank not accepting any short sale offers and my bankruptcy attorney did not tell me to submit a deed in lieu to get the property out of my name. I am now facing $6,320.08 out of pocket fees for the delay in foreclosure.

I have tried for two years to start and complete a home modification loan with BoA. I have sent papers numerous times, called customer service numerous times, resubmitted papers and the process goes on. No one could tell me any information except that my loan was in the modification process. Here I am two years later because of a predatory loan from Countrywide and a ridiculous adjusted rate mortgage still trying to get my loan modified. Now BoA has filed a foreclosure complaint against me in county court. I tried going about this using their process and following their rules. What else am I to do? I want to keep the house but following their process is making it difficult.
The last set of modification documents were faxed again on January 5, 2012. Still nothing, because now the loan officer says they are so swamped with a backlog of modifications that he can't give me a timeline for a decision and he doesn't know anything else about it. But if I want to come up with a huge lump sum of money to reinstate the loan, I can do that now or can enter a payment plan for the same huge sum of money that the BoA corporation is making me accumulate. I am stuck between a rock and a hard place go to BoA for help, because I want to pay my mortgage just with a little lower monthly payment and this is how I am treated. Not to say that when paying my mortgage by phone the customer service person told me I could pay a smaller amount because I had an amount in my partial payment account. Not true.
So again, your company gave inaccurate information to a customer who trusted you and that your employees new the procedures. This little incident set me back another two months of payments not made on time. I try to do the right thing but I keep getting knocked down by BoA. I don't know if this lawsuit against them and Countrywide will affect my loan in any way. Wish I knew.

I experienced a loss of income when my husband and I separated. I fell behind and made Bank of America aware. I went through 3 bank officers and various rounds (monthly at times) of sending in paperwork "due immediately so that (they) could provide a loan modification." Over a year later, I’m apparently in the same boat as the rest of these people!

I am still waiting for a loan modification after a year and many phone calls. I have resent documents about 4 times and I am still waiting for help. I am almost in foreclosure process and I am trying to get help with no answers.

BOA Loan Service consistently misapplies payments, changes monthly mortgage payment stating changes on the escrow account. Puts my agreed payment in the escrow account stating I made a partial payment and show the month delinquent. I am currently 3 months behind but BOA said that I am 5 months and they have already filed a default on my load and foreclosed on my property. I received a letter dated Feb 29, 2011 on or about March 2 stating that my load was being referred to the foreclosure department to the review committee and to call to avoid foreclosure.
So when I called the next day, I was told I was assigned a case manager named Emily to which I contacted and was told that my loan was already in foreclosure on the same day of the notice. She said BOA would not accept the pasted due balance or any payments that I had to clear the foreclosure. I pointed out misapplied payments on the account and numerous errors on BOA to which on the phone with her and the payment research one misapplied payment was located Oct 2011.
I called today because there is a Nov 10, 2011 payment sitting in miscellaneous to which I requested to be applied to my payments. BOA in fact owes me $5,000.00 that was put in the escrow account that should have gone into the payments for our loan modification on 09/2009. There are numerous errors on this account as it was inherited as a Countrywide Loan.

I have been working with Bank of America for 2.5 years now to try to obtain a loan modification. I have heard every stall tactic, lie, been told countless documents were lost, incomplete, outdated, and hung up on. I have not been contacted by my single point of contact for six plus months after filing numerous complaints with Bank of America, and I could go on all day.
We were a Countrywide loan, did a refinance back in November 2005 to an adjustable interest only with a pre-payment penalty for five plus years, and have experienced substantial loss of income and medical hardship. And like I said, I have been working with BofA for 2.5 years and gotten absolutely nowhere fast, except 15 payments behind. Now, we are in foreclosure with no sale date, and the bank has a hold on our account per Rincon Trust and they are waiting for instructions from the bank on how to proceed.
We have a forensic loan audit that I submitted to BofA and all kinds of other documented issues with this whole loan modification process to the CEO/President's office who has assigned me to an advocate who is researching everything. I also have filed complaints with my state's Attorney-General's office (AZ), helpmewithmybank.gov, and various other entities to try to assist me to get a loan modification.
I have been told so many different lies by BofA and do not know what to believe anymore. We thought we were in underwriting for a modification for in-house review after being denied for Hamp (no reason for denial known per the CEO's office). But we just found out from a local BofA branch worker that our scanned file is a complete mess and they believe it will be kicked out by the underwriter whenever they decide to look at it, which according to this branch worker, should have been touched within three days. Yet it has been almost 30, and it is still sitting in this person's queue.
We want to save this house. We are really upside down in it of course, but we just are requesting a low monthly payment we can afford. Principal reduction would be great, but we would be happy just extending the loan from 25 years to 40 with a fixed low interest rate and a low monthly payment we can afford. I have even emailed to the investor Bank of New York Mellon, who emailed me back and said they are only the trustee (whatever that means) and to contact BAC. A new Deed of Trust was also just recorded at my county recorder's office on March 2, yet nobody at BofA knows about it when I called to ask. MERS was also corrected recently as well.
Is there anything else I can do to get this resolved and stop the games over at Bank of America? Is there anyone else I can file a complaint with or contact that might be able to assist me? This has become a full-time job for me here to try to save this home. Please help! Anything I can do I will try. How about the news? Is bad publicity any help? We were just told we were put on a list for someone to call us (about this global department of justice settlement), and they will get back to us in 60 days. But I am not so sure we have 60 days to waste here. Help please!

My husband and I have been trying to get a modification out of B of A for 14 months. We fell behind in our payments in 2010. Over the last 14 months I have had 4 different negotiators, B of A has lost my paperwork at least 5 times and I have had to re-submit it. I have received letters telling me they have our paperwork and then the next day, get one saying they don't have it and since I did not send it in, our mod has been denied.
In May of 2011, we received a call saying the modification was going through so await the paperwork. Nothing showed up, and then we get a call that we have to start the process all over again and that we were given incorrect information. During this process, we have been making our payments. I called on March 7 to make a payment and was told they could no longer accept our payments and they were going to foreclose on our property, but the modification was still in for review! I have no idea where to go from here. We are talking to an attorney and considering a short sale.

After reading the many complaints on this website, my story is nothing new, but Bank of America continues to ignore its customers and the law. While the money is "out there" for Home Modification loans BOA utilizes stalling tactics of losing paperwork and the resending of the same material over and over again. While their customer service agents tell you on the telephone they are there for you, it is nothing more than a ploy, a reflection of the training reflecting what their senior management wants. I have now filed complaints with: my state senator, my congressman and every government agency I can think of. Something has to be done!

I lost my job in August 2010 of not fault of my own. I immediately called Bank of America, trying to get a modification due to hardship. I was told that losing my job was not a hardship. I again called and demanded a modification under one of Obama's recovery acts and was told that since I refinanced in 2009, I was not eligible.
I contacted two of the organizations in St. Louis that attempt to help people save their house and was told by both organizations that BofA is the absolute worst company to work with. After months of not buying groceries and having utilities shut off at various times, I received a letter from Bank of America which stated that they would not help me because I could not afford my house payment? I again contacted BofA's customer service and was told that if I let my house go into foreclosure, there would be more options available for me? In 6 years, I have been late once!

I am building a house and the loan was put in as a refinance (begin the process in July 2011). The house was finished in January 2012 (C.O. completed 1/26/2012). Days before I should have closed, they decided to switch from a refinance to a regular mortgage. It is now March 9, 2012 and I still am not sure when I am closing. It takes a week to get over every minor hurdle.

Bank of America won't give my money back after 5 months! I sold my house and paid off my loan for over $4K because of the adjusted property tax. After everything was done, they realized that I paid over $4K. Now, I moved overseas. I called them more than 5 times from overseas to send my money to my address. When I called them, each time, they told me different story. Last conversation, Bank of America won't send my money because I am living overseas. After almost 5 months, I can't still get my money back. I want to sue them.

Countrywide sells loan to Bank of America (BOA). In March 2011, I had dental work done. I had to use part of payment, so we were one month behind and made every payment afterwards. I’m trying to raise the missing payment. In December 2011, we had a family member passed away with no insurance and we have to spend money to bury her. Now two months behind, we tried to make payment on January 28, 2012 to ensure loan stays at two months delinquency. BOA refuses to take payment.
On February 7, 2011 ask to pay all months due. BOA sends me a letter with reinstatement calculations, we sent five months of payments. BOA refuses to accept and wants $3,600.00 more dollars in fees. No matter how much I call, the loan specialist is never available. I check with local courts and no one has even file a default for my loan or foreclosure or has anyone been by to check the condition of my home.
So fees for attorney is $1,500.00, foreclosure fees $1,600.00 and inspection fees $90.00 are all fraudulent charges. BOA informed me yesterday after holding my monies for two weeks, they sent the check back to my bank. This has to be illegal.

My loan was sold to Bank of America in January, 2010. The loan was set up without an escrow account. We elected not to escrow. From the first payment coupon we received from BOA, they reflected an escrow payment. I was informed, and wasn't quite sure why they were doing this, and just made the increased monthly payment they were requesting, so I wouldn't have any late payments. After several months, I contacted BOA to inquire as to why they were charging more than my note payment. They agreed they were incorrectly charging me for escrows, and said it would be corrected right away. This was not the case. They then paid out my yearly insurance premium to my insurance company, even though I pay our homeowners insurance on my own, as the loan was set up.
I called time and time again, and this was never corrected. I then found out they reported 2 late mortgage payments, due to not paying them the escrows in my payment (as it was illegal for them to charge me for escrows), and made several more calls, which they said they would correct my credit report and have not. To this day, over 2 years later, they are still showing an escrow charge on my monthly billing statements. I continue to call to have the late payments removed from my credit, and they are not doing anything. No one should have to deal with this terrible service. I make my monthly payments on time, and always have done so with my mortgage. I pay the note payment in which I'm required per my loan’s setup. Please help.

Originally, I got my loan through Countrywide. My debt-to-income was way too high to qualify for the house that I got. Once I lost my job and went on disability, I tried several times to modify my loan. I sent in paperwork several times, and every time, they never received it. I eventually lost my home, and my credit has been ruined. Had Bank of America did a modification by lowering the rate I was paying or modifying the loan, I would still be in my house. How do I get in on the class action lawsuit?

In Nov. of 2008, I had to refinance my home into my name per my divorce agreement. I refinanced through Greentree mortgage, who sold my mortgage to Bank of America. In February 2010, I was laid off by my employer of 10 years, at no fault of my own, but due to lack of work (they closed our office). I was given a severance package, and was able to receive unemployment. I notified Bank of America immediately, and was told by customer service that as long as I could continue to make my mortgage payments, they could not do anything for me. I was able to get another job in the same field, but with a lower salary.
In October 2010, I was having trouble making my mortgage payments, so I called Bank of America back. They transferred me to a loan specialist, who asked me very detailed questions about my income, expenses, etc., and said they would start the re-modification process. I received a FedEx package in the mail, which asked me to complete an application, and to send in paycheck stubs, bank statements, my last two years of W-2s, current utility bills, etc. This all had to be back to them in their FedEx paid envelope by the end of November. I sent everything in on time, and waited.
In the beginning of January 2011, I received a letter stating that I was denied, because according to their records, my income of $74,000 and change was too high to qualify, and if I disagreed to call them. I immediately called them, and told them I did not agree with their decision. Bank of America told me that since a decision was made, that file was closed, and I would have to start the process over again. Another 30-45 minute phone conversation of giving them all of my financial information to open another case, however this time, I was asked to get all my records together, and fax it over to them, which I did.
I received a phone call from them a few weeks later, saying they did not receive my information, so I faxed it again. Again, they said they did not receive it, and asked me to take my information to a Bank of America to fax. Before I could get to a branch, they sent me a letter stating that due to lack of information, they were closing my file again. I told them I faxed them twice (with one fax confirmation received), but they said it was too late. It was already closed, and I could start the process again.
In June 2011, I hired Timothy McCabe Law Firm to re-modify my loan with Bank of America for me. Unfortunately at this point, it was months where I could not make my mortgage payment now, and the partial payments I would send to Bank of America were being returned to me. Now with a lawyer, I was definitely unable to make my payments. My lawyer contacted Bank of America, and requested the loan modification paperwork, and a copy of my loan documents to review. During the next several months, Bank of America would continue to call my home 6-10 times per day, starting at 8AM, and not stopping until almost 9PM.
When I said I had a lawyer, they said they had no record of me having counsel. I must have given them my lawyer’s information 4-5 times, until I refused to answer the phone anymore. My lawyer submitted the request for re-modification around August 2011. Bank of America sent letters to my home confirming receipt of the information. In September, they contacted my lawyer and asked that until they were ready to review my file, they wanted monthly updates of my last 2 paychecks and bank statements.
This happened again in December 2011 and February 2012. I just received a letter from them after 7 months of them holding my application, that I do not qualify, because I qualify for another program, and that I must immediately make all outstanding payments, otherwise they will continue with the foreclosure process. I cannot understand how I do not qualify, as I make around $12,000 less per year, than my previous employment, so I am considered underemployed. My mortgage balance of $199,999 is higher than the $140,000 I could expect, if I sold my house on today's market and my property reassessment provided by the township lowered the value of my home for property taxes from $249,000, down to $181,000.
Bank of America told me I could short sell to get out of my existing loan. I asked the customer service person why they could not deduct the principal they would lose off my existing loan, if they were willing to take the hit, if I short sell, and she told me "that is not the way it works”. All I want is to be able to make my payments, and keep my 3 kids in their home. Where/what else can I go or do?

In 2007, we bought our home via a Countrywide Freddie Mac back home loan. At the fall of Countrywide, our loan was sold to Bank of America. We have never been late. We inquired several times with Bank of America regarding refinancing since I had a big change to our income and we are severely underwater with no avail. In October 2011, we notified our mortgage had been sold Nation Star Mortgage Co in Texas, where we made our two timely mortgage payments and also inquired/requested Making Home Affordable/HARP program participation before our loan was sold back to Bank of America on December 16, 2011.
Unfortunately, our home loan came back to Bank of America without our December 2011 payment, which caused us harassing late payment calls for the last two months, unable to be considered for the HARP program until it is cleared up even though I had made conference calls with Bank of American and Nation Star, wherein Nation Star confirmed receipt of our December payment and email confirmation of payment from my checking account to a team lead supervisor at Bank of America. They said it will now take an additional 30 - 60 days to clear up my account even though they finally received my payment from Nation Star, and if the rates are still the same at that time. I somehow doubt it. Also, It would take an additional 60- 90 day to try and get refinanced under the HARP program. Since I first tried to qualify under the program, the interest rate has already raised a full percent. I dread to know what B of A will do as far as selling my loan again or how much the interest will have risen by in the next 3- 5 months (30-60 days + 60-90 days).

We have been members of BOA for 6 years. I put my saving in my husband’s account to pay some bills because we were behind; we are waiting for SCRA to take into account. We have been waiting for SCRA for 2 years and they still have not applied it to our mortgage. When we went to the bank to make sure we pull right checks, they took my last 6,000 dollars out of the account to pay off his credit card. This bank is evil and I pray they all go under. Poor people like us who they are hurting. The lord says vengeance is mine.

We were in the middle of a loan modification with Wilshire when they sold our loan to Bank of America. We are self employed and were having trouble making ends meet. However, we managed to pay our modified payment every month. Little did I know that we were being reported to the credit bureau the entire time. Because they hold your payments and then after the modification is complete, they go back and place the money were they think it should go! So I have six months or more of 180 day lates on my credit report even though our payments were on time! What's even worse, our mortgage payment went up! Bank of America said that because we are self employed, they have to use our business income as our personal income! How is that when we don't pay our mortgage or any of our bills out of our company account! Their modification would end up hurting more than helping. I strongly feel that there should be an investigation of their practices.

Is my family the only people having trouble with Bank of America's mortgage re-modification practices? We have been trying to re-modify our loan since the beginning of last year until finally the mortgage department came down from Richmond to take our information. They told us we had to be 2 months behind to qualify. We turned in all of our paperwork needed in September 2011.
A month went by with no response. We went to the bank to make a payment in October and the teller returned our money. Once someone finally returned our calls, our paperwork that was submitted had expired after two months of waiting and we had to resubmit them.
We received a letter saying our home was going to be foreclosed on. We then received a letter in December giving us a foreclosure date for December 29th. Our counselor told us that we need not to worry. We wanted to pay the back payment but our counselor, Rafael, gave us the balance and told us to hold on to the money until he called us back in 45 minutes. Once he called us back, he told us that there was no foreclosure date. He told us that we could put the money at the back end of the loan.
Two months later while foreclosure fees were still accruing, we were denied the re-modification. So it took them 5 months to tell us that we didn't qualify. When we took it to HUD, it took them under an hour to tell us we didn't qualify. Now they expect us to come up with almost $12,000 when we are only a little over $8,600 (that we could pay today) behind on the mortgage and the rest are fees for a foreclosure that Bank of America initiated (knowing we were going through the re-modification process)and kept postponing the dates driving up the fees.

All I have to say is I agree with all the complaints on here. Their story is my story as well. It saddens me that the house we call home, took pride in and raised our children after 24 years of blood, sweat and tears is now in jeopardy of foreclosure. No sure! We have applied for loan modification since I lost my job and done without meals to try to keep BOA happy, with no avail. As of today, we have heard nothing from BOA, no phone calls, no customer service, nothing! After three years of waiting for a modification and trying to get BOA to lower my payments, still nothing.
I am exhausted and mentally can not take anymore. This whole ordeal is robbing my husband and me of our spirit and our happiness. I will continue the fight if anyone knows a good Kentucky lawyer. All the large firms say they can't because they represent banks. So far, we have not been fortunate in finding one. I am now working, thank God! Now, I make too much! Go figure. I just want to do the right thing. Does anyone know if there is a class action suit in Kentucky that I can sign up on?

I am in the process of attempting to refinance my mortgage with BOA and it has been a nightmare. I spend most of my days off from work gathering information or physically going to different offices to help BOA obtain the paperwork they say they are not receiving. I have done a refinance in the past with Fleet with no problems and this is the most labor intensive (on my part) refinance I have been through.
The worst of it is that my BOA representative calls me and leaves unintelligible messages requesting documents that don't exist, that they have already received, or giving unclear requests for me to follow up with documents and then threatening me with cancelling my loan if the materials are not received within a very short time frame--usually a few days, which puts the responsibility for getting in touch with them to clarify things on me. This has happened over and over again.
The first difficulty I encountered was with my appraiser assigned to me by BOA. The appraiser cancelled her meetings with me over 3 times due to traveling around the holidays. I also have tenants who work and go to school and I had to reschedule with them as well. BOA has been responding by threatening me with cancelling my refinance since my appraisal had not been done. I told them get me another appraiser and my appraiser finally showed up right before the BOA deadline.
My BOA customer service rep asked me for terms of withdrawal paperwork for my IRA. Over 3 separate times, I told her via phone message and email that there are no terms of withdrawal paperwork for an IRA. I even had my banker, who is managing my IRA, fax them documents explaining this. She responded by threatening me with cancelling my loan if she did not have the terms of withdrawal information by a certain date and "did I need help understanding what she was asking for."
Terms of withdrawal accounts are only part of a $401K account. They don't exist for a standard IRA account. BOA had the account statements for my IRA where it states standard IRA on the front of the paperwork. After a couple of emails to her supervisors, explaining that she was asking for the wrong thing, she finally recanted. However, now, most recently, my rep tells me that she is having difficulty confirming my employment through my companies HR department and if they don't have what they need within a week, they will have to cancel my loan.
I go to HR myself (on my day off work) and fill out a paper and fax the confirmation letter to BOA. My rep confirms receipt of this letter but tells me that there is a specific BOA form they need that is supposed to be filled out by my company's payroll department (now) and not HR like they thought. And they need it in 2 days or they are going to have to cancel my loan. They wait until the very last minute to tell you they need something. I have a rotating schedule and have to hope my days off will correspond to the days when my BOA rep decides to call me and leave an unintelligible voice mail.
BOA's customer service people are unprofessional, inexperienced with standard banking information, and they are bullies who love to threaten you instead of doing their jobs properly. It seems like BOA people are overworked; however, there is not an excuse for my customer service reps' nasty attitude. It's like they have no interest in approving my refinance. I am not in foreclosure. I have been current with my mortgage for ten years and have income from my tenants that covers most of my mortgage. Also, I have over a year's salary in the bank yet BOA has made this a very difficult experience for me.
They already charged my credit card with a $675 processing fee; however, I feel like I should get a cut of that because I am doing a good portion of the work myself. My friend told me not to use BOA for my refinance but I went ahead because my current mortgage is with them and thought it would be easier and less labor intensive than going into a new company. I was wrong! I have emails and voice mail messages documenting everything that went on so far during this refinance and I plan to file several complaints because no one should be treated this way!

Last November (2011), I was relieved to learn that B of A had completed provisions to accept the revised HARP program (ability to lower rates for a 20-year note to help me reach equity in my home because I was over 125% under water). I reached out to my mortgage person and didn't hear back for 3 weeks. The 4th week, I received a letter in the mail stating my loan was sold to M & T Bank. I started to call around seeking advice on how to participate in the HARP program. I'm not a realtor, so I'm trusting this information is valid: because M & T Bank is now considered a "3rd party lender", and because my home is backed by Freddie Mac (traditional fixed rate loan), I cannot participate in the HARP program. More background information: I closed on the house in September 2007 with CountryWide. It was later taken over by B of A. I have never been late on a payment. I am currently $30k underwater in my home based on a nearby comp.
From the information I was able to gather, only Fannie Mae backed homes qualify for HARP when a 3rd party lender is involved. Here is my accusation: that Bank of America went through their loans and targeted loans that they knew were underwater; that the owners are current with their payments and the owners may be using (or looking into) HARP to lower their rates. And that these loans were backed by Freddie Mac (knowing there was no provisioning for Freddie Mac backed loans and 3rd party), then selling these loans to smaller banks that currently do not participate in HARP. Thus, B of A doesn't lose any money and that M & T Bank (or other 3rd party bank) doesn't lose any money and locks the owners into their "higher" rates for the same terms. I'm curious to know how many loans were affected by this in the last 5 months.
What kills me, is that for years, my friends and family kept telling to stop renting and buy into a home as an investment. I finally did this, and not 8 months after I close the market took the dive. I've worked hard since my early college days to correct my wrong-doings regarding my credit and scores. I don't want to walk away from the house, but at this rate it will take at least another 10 years to get close to breaking even, which is why the HARP program is here--to re-fi into a lower current rate for 20 years and to help reach equity within 5 years, not 10. In 2010, our income dropped dramatically and I called Bank of America to let them know that I may be missing payments and asked what they could do to help me. I was told right off that I had to be 3 months behind before they would even talk to me.
Four months later, we were behind and I called again. This time they told me to apply for the home modification. I got all the information they required and faxed it to their office. I had to do that because our local office no longer handles any loans, they only handle payments, checking, and savings. They did let me use their fax machine, which was nice of them. So, I fax the info and was told that it could take 60 to 90 days to hear from them, if I was approved. In the meantime, I am still struggling to make payments. I proceed to call and check on the process, always getting nothing has been decided and was assured that while in the process of application I would not be foreclosed on.
Finally, in February, I got a letter, thinking it was the letter for my modification I was a bit excited, instead it was a notice of foreclosure. I immediately called them and was told that my modification had still not been approved and not to worry. I would get at least 3 more notices before they foreclosed. I got another letter stating my home would be sold on the court house steps in March. I called again and was told that my modification was denied because my monthly income was too high. (We made less than $900 a month.) So there was nothing they would do for me. I then hung up and called a lawyer. I was given the option to file a Chapter 13 so I could keep my house. This process made my payments higher, not really helping much, but it was all I could do to keep my home.
I struggled for nearly a year to make the payments but managed it. I then got to where I cannot make those payments, but could afford the house payment, so my lawyer advised me to file a Chapter 7 on everything except for the house and by taking over the payments again that maybe BOA let me reapply for modification, and if I was making payments that they would not foreclose. Since having the 13 dismissed, I have made 2 payments but not without hassle. I had to have approval to make the payments and as for this month (Feb), they have yet to approve me to make it. I have already been approved to make payments before, but not this time.
Today I called BOA to send a reaffirmation to my lawyer so that when I can refi I would be eligible. They stated that since I was behind still on payments, they could not do that. When I called, I was first hung up on, then the second call was disconnected while in transfer. The third call, I got transferred again and got we are closed message. The fourth call, I got a lady I cannot understand and is very hateful with me. Of course, I was frustrated by this time and ask to speak to a supervisor. She puts me on hold for over 5 minutes then comes back to me to tell me she is transferring me and I got a machine with an out of office message. I left a message but not expecting a call back. Every representative tells me something different, gives me different information and does not seem so helpful in anything but assuring they want to be helpful.
So I am now waiting to see what they will tell me tomorrow or Monday. By the way, my bankruptcy will dismiss on Monday as well. They will not take my money, they will not help me in anyway, and they are not consistent with any information. I am at a loss and have suffered emotional stress and depression with all this. We are finally in a place to be able to make payments, even maybe start paying more each month. But what is a person to do when no one will talk to them or even take a payment? My lawyer informs that if BOA does foreclose, I am eligible to file for bankruptcy again, or get a loan and pay the rears.

No consequences at the moment as this just took place today. I was signing off of a refinancing loan app to fax back to Bank of America when I noticed several discrepancies. They were charging me with a full appraisal, though the type of loan did not require an appraisal. Agent said he would take care. I mentioned that the house was not built in 1900 but 1970. He said the block was blank and had to put something in. I said, while he was at it, that I did not purchase the house for $190,000 but for $140,000. He obviously did not have any problem falsifying documents for his own pleasure. He was very good and nonchalant about what he had done. I can only wonder what he is doing to get me in a program I might not even qualify for. Oh, the loan paperwork was for 30 years but I requested a loan for 15 years. He said he could just send another document to make it a 15-year loan.

No one at Bank of America knows the property at ** Marco Island, FL 34145 was sold at a foreclosure sale. This sale was in the circuit court of Collier County at Naples, FL. The certificate of title was issued to The Duchess Condominium Homeowners Association, Case # **. I have contacted 5 people in Simi Valley, CA and no response. This transaction took place in January 31, 2011, one year ago.

Bank of America is the worst home loan bank in the US. In Nov. of 2011, we sent our payment in as always. In Dec., they sent the payment back, and stated they do not accept partial payments, because the payment was short of $12.59. When I called, they told me my payment went up $12.59. I was not aware of this, and by them sending the payment back, it went against my wife and my credit, as a payment 30 days late, like we never sent it at all. Then we took care of it ASAP, and they called us and sent letters that they were foreclosing on our house in January 2012. There are people who haven't paid their mortgage in years, and we have never missed a payment, and they are taking my house. I am very angry, and I am filing a harassment case against them.

Long back, I requested for a loan modification (since my wife lost the job), but my request was declined. Now, I requested for a refinance and the same was done charging about $5,000 to my principal amount and thereby increasing my liability. Is this the way of helping poor and low income borrowers like me? Is this Obama’s plan for poor borrowers to help retain their primary residence? Please take steps to refund the amount charged as closing cost and other expenses.

For the past 2 years I have been working with BofA on a loan modification. I was accepted into the Home Affordable Program and began making my trial payments May 2011. I made all the trial period payments on time over the 3 months. Upon completion of the trial period BofA negotiated a permanent loan for me. While I waited for the permanent loan documents to arrive in the mail, I was told to continue making payments on my loan based on the trial loan agreement. I received the permanent loan documents in the mail 3 months later and immediately completed the required documents, which by the way came with the instructions on how to fill them out. I went to a BofA local to my home and had the documents notarized and return them to BofA via overnight express mail. Time was October 2011. I continued to make payments based on the trial loan agreement. Working with my assigned agent, who by the way was different every month--never was I notified of the agent changing and never was a provided with a new number to able me to contact BofA. Each month when I made my payment I had to call into a number and get the run around because no one knew what was going on with my loan. All along I am getting letters of default, letters of foreclosure, and letters from another department at BofA that I need to attend special Home Affordable seminars.
In December I actually attended a home affordable seminar, went through 5 hours of consultation with BofA agents, had my permanent loan reviewed and prepared. As I waited for the final approval process and would be handed my new loan package, after 2 hours of sitting watching movies in their waiting area, I was told they had to get a copy of title in order to get the investors approval. BofA indicated they would call me in 2 days. After 2 days, I phoned my agent at BofA who had no idea what I was talking about and said I should of never went to the seminar, which they scheduled me for because those BofA agents did not have authority to provide me a permanent loan. Today, I am still making payments based on the trial loan agreement.
It is now March 2012, almost a year later. Each time I call my agent at BofA, I have to leave a message, which never gets returned. So when I make my payment via the phone I have to call 1st to 2nd to 3rd level supervisors, leave messages, send online messages via the BofA mortgage webset; eventually, after about 3 or 4 days, the agent eventually calls me back so I can provide her my information to make my monthly payment. I have had it with BofA and the lies and unprofessionalism. I get the run around as to why is my permanent loan taking so long, when will it be complete, how do I know where or how my payments are being applied. If I go online to view my mortgage statements, they show I am in default and that I owe 70k in back payments.
And get this, last month I made my loan payment via phone call and BofA presented a draft of 75K against my checking account. It of course bounced and my bank charge me a return check fee. It took 3 days for BofA to return my calls. All the said was: “Oops, sorry, we made an error.” I am still waiting for my permanent loan, which my agent said she has raised this issue to higher level supervisors. Who? What are their names? Numbers? I would like to just get this behind me and move on. The permanent loan isn't even acceptable. The home is worth 435K, the new loan the offered is 600K, and they stretched it out to 40 years to make the payment affordable. I guess that’s how they can call it the Home Affordable Program. Monthly it's affordable, but in the long run the home will never sale for what is owed and at some point we will have to walk away from it. But, hey, it’s affordable. This process needs to be fixed and BofA isn't going to do it alone.

In early December of 2011, I received a phone call that my mortgage was behind for three months, and that my house would be foreclosed. This information was shocking to me, so I immediately visited the Bank of America's local branch in Alexandria, VA. I travel a lot, and make it back to Florida, as business allows. Until early December, I had no knowledge of any problems with my mortgage. My payments are automatically deducted from my checking account, and I have been banking with Bank of America for several decades, and have not had a shortage of funds to pay for my bills.
In December, I spoke to Shahid **, a personal banker in the office, located on Duke Street in Virginia. He spent over an hour with me, and the office responsible for collections. He was able to get the payments paid (September and October). I tried to pay December at that time, but the system would not accept the payment. I told him that my wife had received a check from Bank of America, and we asked if a stop payment should be done. He spoke with the mortgage department, and was told to deposit the check. I asked about my credit report not being affected by this occurrence, and was told that it would be corrected. I was informed that it would take until the middle of February to be corrected.
My wife followed up with the three credit reporting agencies in February, and the payments had not been applied, as promised. She called BOA mortgage department, and was told that the bank manager was in error, and should have put a stop payment, and deposited the check, and the credit report would not be corrected, due to the bank manager's error. Today, 23 February, 2012, I was informed that Bank of America would only reduce my late reporting by 30 days, and that this was my fault, because they had informed me that there was a problem with insurance, and that I did not respond to the request. I travel extensively, and there is also a problem where my wife's name is not added to the account, so she could not talk with Bank of America, or receive mail due to this.
I wrote this letter, because the first I ever knew there was a problem was when I received the phone call. Why did someone not call me prior to them? Why was there not some registered mail sent to me? With all the problems that are out there with home foreclosures, I find it alarming that Bank of American can allow this incident to happen, and to hurt my credit. I am copying the individual who was most helpful, and I hope this letter finds its way to someone who realizes this is not the kind of banking that promotes customer loyalty, and 25 years of deposits.

Bank of America made me fax in copies of my pay stub for 5 straight months and my bank statements for 6 months. They never returned my phone calls. They kept telling us we were in review but each month we were falling further and further behind on the mortgage. I came back from work and got a foreclosure notice on my front door and called Bank of America. I got no where them as usual. I went online and was searching for help. I finally got out of foreclosure and got my mortgage restructured thanks to help from a company in CA called Consumer Financial Group. They help me and they even got my rate cut down to 3.5%. I can actually afford my mortgage and don't have to deal with those liars at Bank of America. They lie and they are not organized.

Short sale - They will not approve my short sale because the buyer is using her IRA and the deed must be made with both the IRA firm and the buyer. BOA has lied throughout the process. It is almost as if they want my house to go into foreclosure.

I had scheduled an online mortgage payment for 2/10/12. In the meantime, my mortgage modification was approved, and they put a hold on my online account, so I could not tell whether or not my payment went through. I called and called, left voice mail messages for everybody in their so called mortgage department, and no one ever returned my call. I mailed them a check for my mortgage payment. They cashed them both on the same day. That left me in a bad way. It is now 2/28/12, and they refuse to return the double payment, saying it was not the bank’s fault, even though they never returned any of my calls for three weeks. In good faith, I mailed a payment to make sure it was not late. Now my other bills are late, and I still have never talked to a mortgage rep. This is bad business.

I have applied for a loan modification and was turned down for it because I was current on my mortgage payments. In Bank of America's reply letter, they stated your loan is not eligible for a loan modification because you were current at the time of the evaluation and after reviewing your financial information that was provided to us, we have determined that you are not at risk of default, because you have not documented a financial hardship that has reduced your income and increased your expenses.
They also stated that they want to help me avoid foreclosure and if I remained ineligible for the home retention option and can't afford to stay in my home, that short sale and deed in lieu of foreclosure are my options and we are here to help.
First of all, they are not there to help me or anyone else. The Making Home Affordable Program is a lie because if I can not afford my home, you would think that they could make it affordable.
Before I applied to the modification, I was screened by a representative to make sure that I was eligible to go to the next step. My family had incurred medical bills that impacted my already tight budget and forced us to be late on a few payments. I was told by BOA customer representative that handles my account, that I should not pay my medical bills because that healthcare providers would still have to provide medical care to us because the law requires that.
I see that there are millions of us out there that are still holding on to our homes, despite the fact that they are not worth what we are paying for. I see that the banks are paid by the US government for each foreclosure at a rate of $.67 on the dollar and it is probably already a done deal to take the remaining homes that are in or near default. I see that on this website alone that there are so many bad complaints for BOA, it would be impossible to read them all. I can't put all of the blame on the Banksters of America because they are supported and funded by the US government/tax payers' money. Bank of America does have the power to lower interest rates and lower mortgages but chooses not to, because of greed.
When the President and Congress bailed them out of the hole, they buried homeowners in another. I see that the CEO of BOA, Brian Moynihan, is not getting a bonus this year, along with his salary being frozen, this is probably due to the fact that they will be laying off thousands of BOA employees soon and it would look bad for BOA to give him a raise.
It is a crime that our own tax dollars are used against us to steal our homes. Lawyers and politicians are the ones that should get the blame because they are the ones who create the policies and laws that harbor these white collar criminals.

I have been getting harassed by BOA for the past two months with vacancy notices that are being left on my front door. I keep calling them just about every week, to tell them that my unit is not vacant and that I reside there. But they're telling me, because I'm in default that they have to leave these notes. I was in default back since 2005/2006 and returned to work, I believe, back in 2007 and I made payments every month and I'm continuing to.
Back in 2005/2006, I lost my job after purchasing my unit. I was out of work for about a year and a half and the loan was in default and has been. But once I got employment, I have paid every month up until about a year ago. I missed a month or two due to a medical condition. I want no problems with BOA, I just want them to stop the harassment and let's try to work together because the place when purchased was brought at $149,900 and now it's only worth $90,000 and I can't even get them to modify my loan. This is so crazy and I'm paying and have been, except for a few bad months due to me being out of work and trying to get caught up on everything.

My husband and I had our loan bought by Bank of America because of what happened to Taylor, Bean and Whitaker. They said we were behind in a payment right away and it was because the payment went to T,B&W. They would not leave us alone and had messed everything up so we did a refinance and our first payment was due August 2011. When I got our first payment slip, it said we owed $1,300.00 when we only really supposed to pay $970.00. When I looked at the escrow summary, it said that we owed for two home owners insurance. When I called, they said they had messed up and would fix it to send in the $970.00 payment and it would be fine. I sent the payment in and they sent it back saying it was not the full payment and so I took the papers up to my local BOA. They called and they were told the same thing I was but all this time never telling me what the problem was. They told the BOA worker that I needed to send in my $970.00 payment in and it would be accepted. It was not and was sent back to me.
Now it is Oct. and I sent in two payments in one, they sent me part of it back and kept the $1,300.00 that they said I owed. I have called and went to BOA and had them call. I have sent my payments in, like they have told me to, it keeps coming back to me. Finally, I went to BOA in Jan. and had them call again and they were told that BOA paid my homeowners insurance but then bought their own homeowners insurance and that is what doubled our payments. They said they were going to refund the money to us in Jan. 2012 and in Feb 2012 it would all go back to normal. It is March just about and we have still not received to refund and they are still saying we owe more than we need to. I keep sending in the payments they tell me to and they keep sending it back. What should I do? I am at the end of my rope with them. No one will give me a straight answer and they admit it is their fault but will do nothing to fix it. They need to do something, I am getting heartburn all the time now.

Loan Modification with Bank of America: I have been attempting to modify my loan with BOA for over a year. After being denied while trying to work directly with BOA, I started working with a third party agency which I paid almost $5,000 for their assistance. In approximately 6 months, BOA finally sent me a packet of 7 pages which congratulated me on being qualified for a loan modification. BOA is asking me to pay approximately 60% of my original monthly mortgage amount for 3 months, and then they will let me know what exactly I am agreeing to. I am overall satisfied with the new amount and seems much more affordable, but when I ask for specifics about the new loan (i.e. terms, what the new loan amount will be, what is the new interest rate, whether it is fixed or variable), I get this amazingly frustrating run-around. I won't even go into the details on how shady the first loan signing was with a BOA loan agent high pressuring me and crunching numbers to make it look like I could afford it. He even said the original low was locked in for the duration, but I was told a few years later that that was not true. I really want to stay in my home but want some clarification on what I am agreeing to before I hand the bank over an additional 3 months of loan payments.

I started my first home loan process with my local Bank of America in July of 2011. Since the start of the process, they required new information from me twice-three times a week for 6 months. They could get a hold of me whenever they needed more information, pointless information. For the past 3 months of this loan process, I could not get my local agent to call or email me back for weeks at a time. I then would contact the mortgage person above her. She would always only take my number and tell them that she would have my local agent call me back immediately, still no responses. I was told three-four times that my loan is secure and ready to go when it most certainly was not. I finally, after 6 months of **, decided to call and tell them I want to cancel the whole process. I still have received no response. I am so incredibly fed up with this bank it is not even funny.

For the past 3 years myself and the other co-owner of our condo have been paying half each of the loan payment always on time and with a scheduled payment from our individual BofA account. My portion of January's payment was put against the principal because 01/01/2012 was a holiday and the payment was withdrawn on 12/30/2011, which they considered as an "extra". The other half that was sent on 01/03/2012 was put in "limbo". This caused our January loan payment to default without us even knowing about it since our payments were made. They never called us, emailed us or anything. The other co-owner noticed the payment still due the next month on the mortgage website and called BofA. They told her that they had returned her portion of the payment in a check on 02/02/2012 because they did not know what to do with it and that what we had to do was to pay again in January and have me call to request my portion to be taken out of the principal and refunded.
To make things worse, we both paid January again online because their system does not refresh the payments automatically. I called BofA and had to explain the story again and they told me they would send me a check. Neither check came. So I called again and told them what happened. Nobody had issued a check for my portion according to the customer representative at the payment research department. Why did they say they did? They just lied to us. So, the representative said that the other check issued on 02/2/2012 was on its way and that she would mail me a check overnight. I finally got the check.
The other co-owner just called yesterday because we have not received that famous check for half of the payment in January that she paid. Again, after telling the story one more time, the representative tells her that no check has ever been issued and that they cannot return the money! Again, lying. And in the meantime, whenever we spoke to the representatives to request the refund or to reverse two penalties, they have messed with our account so badly that we have 3 pages of transactions from December 2011 to today. It is impossible to follow what they have done with all the adjustments, reversals and miscellaneous postings but we are still short of half of the payment from January that the owe us since we paid it again.
Their customer representatives are ignorant and liars to say the least and they are rude and do not treat people who speak English as a second language. We have closed all our Bank of America accounts since this incident and moved to First Tech and opened a joint account there where we will make one single payment since they can't deal with partial payments. A bank that is supposed to be cutting edge cannot handle two payments. Thank you.

My name is Rebecca ** and I currently am dealing with Bank of America regarding foreclosure. I am physically and emotionally drained due to the fact that Bank of America has not been very cooperative with my ordeal. Me and my husband have worked all our lives and for the first time on June 26, 2010 we became unemployed. We continued paying our mortgage the best that we could but come May 2011 we were really struggling. We decided to contact Bank of America to find out what options we had to help us pay our mortgage. I was offered the modification application which was filled out and sent with attached documents.
We begin working again in September 2011. After several calls with no answers finally in November we found out through an attorney that our home is being foreclosed. I called continuously and sent faxes and nobody had answers. My home was due for foreclosure on December 6, 2011 without any notification. I decided to call an attorney due to no response from the bank and he advised he would put a restraining order until we could figure something out. We went to court and nobody from Bank of America showed. I have called and tried to figure this out but it has become impossible because nobody knows anything. I was advised that my modification was denied yesterday and now that's the end of any answers. I was told in the letter that the modification was closed due to unable to verify income. I sent everything! I am making enough money now to send what I owe but nobody gives me any answers.
I need your help please. I am not going to lose the home my family has dreamed of. I am not denying to pay but please I need someone to give me answers. We are scheduled for court on March 19th to find out what is going on. I wish this nightmare would end and I could be at peace. This has caused severe emotional and physical distress. I want answers please. This has to be illegal!

We have been homeowners since 1988. We have been in our home for over 13 yrs. We have raised four children in this home. We want to keep it. We are requesting your help.
Since Sept. 2009, we have requested an explanation of why our payments increased instead of decreasing (variable rate). This is the original reason for the delinquency. As of today, no one has contacted me to explained this (I faxed a request several times - the last times were Sept. 28, 2010 and again Oct. 15, 2010).
Reluctantly, we agreed to do a modification because we did not want to go into foreclosure. The payment was $1899 but went up 30 days later to over $2043. They stated that they were still investigating. I continued to pay the $1899 but fell behind due to unexpected major car repairs and dental bills.On April 1, 2011, I went to a Bank of America Outreach Event in Atlanta. I submitted all my information to a representative. She stated that I would be contacted. I did not make contact with Bank of America until August 2011. The representative said that it was declined due to "not getting additional information in a timely manner." I told him I was never contacted. He then asked me to resubmit my information (August 2011). I started receiving weekly taped messages that it was in the process and that "no additional information was needed." In December 2011, I received a letter stating that I have been declined due to "did not receive additional information in a timely manner."
On January 28, 2012, I received a letter that they were reviewing my request(?). Five days later on February 3, 2012, I received a Foreclosure Notice of sale for March 2, 2012. I have been waiting since September 2009 for an explanation of why my mortgage payments increased and I have been trying to get help on my mortgage since March 2011. Now I might lose my home of 13 years in less than 24 days and I am getting so behind on my mortgage that it will be impossible to catch up. I am running out of options and I do not want to lose my house.
My only option now is to file bankruptcy to protect my home.

We too had Bank of America. In 2009, I lost my job, and we started to get behind on payments. I called Bank of America to discuss getting a loan modified. They took our expenses over the phone and told us that we did not qualify for a loan modification at that time because we had $200.00 to live off after our expenses. So for the next year, we struggled and struggled until we were 4 months behind again.
We called in August 2010 and again tried the process. This time, they said we were over by $700.00 and that we need to scale back some of our finances to apply. Huh? So I asked how we can do that, and he/she said, "You will figure a way." So we did, which in return was false information the bank wanted.
In November 2010, we called them yet again and gave them what they wanted. They told us good news that they could modify, and our payment would be $700 a month instead of the $1000.00. They said we would get a FedEx package in the mail. We needed to sign the papers in order for it to be valid. The papers came the next day. We opened it, and the paperwork stated that our mortgage would be $1300.00. What?!
I called back, and they said, "Take it or leave it." After their finalization, they have determined this is the amount our mortgage will be. We declined and tried it again in May 2011, and they told us they are not doing loan modifications any more and that our house will be auctioned off the following month. So we moved out June 2011. It has almost been a year, and we received a letter this week saying they are going to charge us for abandonment. What?

BofA padlocked my home on 1/09. I filed Chapter 7 in 3/10. BofA kept sending letters, saying I owe them for my home. I called and sent letters to them to foreclose the home. I have not lived there since 2007, after my divorce. Now, due to BofA not putting it on the market, and them forgetting about the home, I can't purchase a home. I have great credit score of over 710. The only item I put on BK7 was the home, and an RV, that on court paperwork, my ex was responsible for the RV, and home was to be sold, but my ex and his wife lived in it, until BofA padlocked the home, and forgot about it. Now, due to all the foreclosures, I am stuck in a rental, and can't buy, since BofA, after so many calls and letters, foreclosed on the property in 10/11. I just want to purchase again, and the negligence of BofA foreclosing, is the only thing stopping me from doing so.

I made a mortgage payment early on our primary home on 12/31/11. Bank of America applied the payment to the principal, not as a loan payment, then started calling my house and place of work demanding payment and assessed me late fees for two months of late payments when it was a mistake on their part.

I originally had a home loan with Countrywide that switched to BofA in 2009. After they took over, I found an extra $30 a month added onto my payment. I discovered that this was a mortgage reserve requirement. I looked up what it was and found that this was supposed to be returned to your account at the end of the year if your escrow costs did not exceed the increase in escrow costs.
However, BofA did not give back that money and also added $1.30 escrow shortage fee each month in the possibility that my escrow did not add up. I had filed a lawsuit against them, and they dropped and refunded the charge for that year. However the next year, they added it again then dropped it when I called. They have added it again this year, and I will be going to court this time and not dropping if they try to settle again. This is $300 a year that they are stealing from a lot of good always-on-time customers.

I purchased my home in 2006 and in 2009, I started having financial problems. I heard about all these "help for homeowner" programs, refinance programs, etc. I contacted Bank of America in hopes that I could refinance, or would be eligible for a program so I could keep my house for me and my child. I got the run around for about a year, with no positive help from Bank of America. Instead of foreclosing, I began the short sale process, which again, having Bank of America help through that process was devastating. I was about to walk away.
Things were finally settled in August of 2010 and everything was settled. Now, almost 2 years later, running my credit, Bank of America has submitted this to the credit agencies as a foreclosure, which it never reached that far. When I called to have it fixed, they said that they have it logged as a foreclosure. I never received anything from Bank of America 2 years ago about starting foreclosure proceedings. It was strictly a short-sale. On top of that, it is still stating that the foreclosure proceedings are still going on with a balance on my account. After being on hold for about 1/2 hour, I was told it would take up to 30 days for them to review it to be fixed. This is not enough for me. They have lied to the credit companies and has hurt me in the process.

Home Retention Program - In 2010, I had some medical issues that left me temporarily disabled. We called the bank to let them know that we would have problems paying our mortgage. This was after we had already requested help five months prior.
The lady we spoke to over the phone asked a bunch of questions regarding our finances and debt. I'm not entirely sure why on the debt as she seemed to have it all on her computer screen. She informed us that after all our bills, mortgage, gas utilities and food was paid for, we still had $100.00 left, and this was sufficient enough to live on. I guess nobody has emergencies anymore.
In Oct. 2010, we called again as I was out of work. I was told that we were not behind and asked when I would be able to make up the late/missed payments. I explained to the rep that I wasn’t sure when I could expect to see any benefits for my disability so I didn't know. He then proceeded to tell me that our loan was under review for modification. I told him that we were denied and he said that we were only missing some information and if I could call another number. I called the number he provided, found out what was missing and faxed it right away.
After several phone calls and being told that they never received any of my faxes even though my fax machine read send successful. Finally, once recovered and back to work, I was put in contact with a negotiator.
I was asked again to create a hardship letter explaining why we fell behind and what changed in our finances, a spreadsheet showing all our bills, utilities and debts, along with bank statements, paystubs, etc. only to be told my debt was over by $900.00 a month and he could not get my modification to qualify unless I shaved $900.00 off of it. I asked him how this was possible as the bank would reflect that what I reported was true. He told me he couldn't tell me where to take it from, but that the banks do not like to see sloth purchases, entertainment and that I spent too much on food. (Michelle Obama, look out child obesity, here we come. My children would have to live on peanut butter and ramen to make this work!) Needless to say, he asked me to commit fraud.
Finally, after doing all of this three times over, in April of 2011, I was told that my modification was approved and my payments went down by $400.00 and that I should expect a FedEx envelope with an agreement that would need to be notarized and the first months payment would be expected with a month reprieve from payments. It sounded pretty good to us. Two days later, we received the package, only the monthly payment actually went up by $400.00. When I called the bank, they told me too bad, I could either take it or leave it. No joke. It was pretty much the exact words.
I held onto the paperwork for a day to think about it until my negotiator could get back to the office. When we spoke, he told me that if I simply signed and paid the amount it would stop the foreclosure process and I could request another modification.
One month into my first payment, I knew we would have difficulties paying and I found out I would be going out for yet another surgery. I called again only to be told that I could not request another modification because BofA stopped allowing people to do this. So I stopped paying, set my mind to the fact that we were going to lose our home anyway and began looking for rentals.
A month ago, we received a FedEx package saying they would be sending a representative to our home to try and help us with what options were available to us. So far, the gentleman (who I found out does not work direct for BofA, but is contracted out) came and picked up the paperwork and hopefully in the next week, BofA will have it and we will know something. I will say that if they come back asking for more documents, or updated information, I am done.
Our home is in distress, we are unable to fix it, but as long as we are broke, and stressed the bank is happy. I refuse to live my life this way anymore. I feel like I have wasted 9 years of being worried about bills, missing out on things my family and I could have done, but didn't because we didn't have the money, arguments with my spouse, household emergencies that come up and break us all over again. (Just when we think we are getting ahead and have some breathing room.)
I feel like someone really needs to expose BofA for what they are. It makes me wonder how those people can sleep at night knowing the lives that they have ruined.

We have our home loan with BOA due to Country Wide selling their loans to BOA. Never have missed a payment ever. We had been told over and over that we were pre-approved for a lower rate (quoted and documented at 4.50% and that we had been checked, our credit rating check and it would be simple process). We just had to pay $450 up front to process all the paperwork and the mortgage representative was helpful and kept calling us back to stay on top of the process. We discussed some issues up front and were assured that these were not a concern.
After BOA sent packets and packets of paperwork and we completed these, (by the way, could never get anyone on the phone and when we did, they were rude including the initial person that we talked too originally). There were endless questions and documents stating why we were possibly not going to be approved and the paperwork kept coming. These issues were discussed initially and were told that these issues would not be a problem, but after we paid the $450 and the process started, they prudently became an issue. We finally cancelled this transaction and were told that the $450 would not returned. They adamantly misled this entire process and this is truly a new scam to collect money up front.

I am writing to condemn the extreme malpractices of Bank of America (BOA). Sadly, Bank of America has foreclosed on innocent victims without a justifiable cause. This is what has led to a request for an independent review of how foreclosure processes was handled, by major banks including Bank of America by the Office of the Comptroller of the Currency (OCC).
I have two complaints against Bank of America. Our property was refinanced by Bank of America over ten years ago. We opted for our monthly mortgage payments to be automatically deducted from our account at the end of every month. On February 29, 2008, I asked Bank of America to defer the March payment due to a death in the family (an acceptable practice at that time). The fee for this service was $5.00 which was charged to my account.
One day in May 2008, I came home from work to see a BOA ticket hanging on my door asking me to contact their office. I called and was informed that I had not paid my mortgage for April and May that year. The agent who had handled the deferment had mistakenly stopped the automatic payment. I advised BOA to reinstate the automatic debit and to take the two payments to cover for the two missed months. The bank took the payments. The following month, Bank of America took an additional payment of $87.00 from our account. We decided to stop the automatic debit when we could not a good explanation from the bank for this charge.
In December 2010, the Bank informed me that I had accumulated some late fees of well over a $1,000.00 despite the fact that our mortgage payments up to this point had been timely. Bank of America sent me a detailed report of all payments made between December 2007 and December 2010. Analysis of the report revealed that the two payments made in May had been posted incorrectly. This set up a domino effect causing all subsequent payments to incorrectly be recorded as late payments, thus the late fees. For six months with the help of a manager at a local bank, a great deal of stress dealing with unintelligent agents at BOA, the payments was reallocated. Bank of America however refused to reverse the late fees.
In August 2011, BOA sent me a letter stating that they have purchased a lender placed Insurance on our property because they do not have evidence of homeowners insurance on their records. The cost of that insurance is $2,813.00. I contacted AAA, our homeowner insurer, set up a conference call and resolved this matter. BOA removed their insurance off our property.
In October 2011, I received another letter from BOA again stating that I do not have windstorm insurance and therefore they have purchased and put into place such insurance. The insurance was purchased on 10/18/2011. The insurance premium was $7,234.65 starting from 06/06/2011. Please note that the insurance was purchased on 10/18/2011 and yet the coverage was to be from 06/06/2011.
In December, a mortgage payment booklet arrived in the mail from BOA showing that as a result of this purchase my regular mortgage of $899.95 has gone up to $2,700 a month. I laughed at the absurdity of this case because the monthly insurance premium is twice the mortgage payments.
In January, when BOA refused to accept my mortgage payment of $899.95, I purchased the Windstorm Insurance from TWIA. The policy cost approximately $1,500.00. The policy will cover from 01/25/2011 to 01/25/2013. My complaint is twofold:
1. Texas Windstorm Insurance Association is a government organization that sells this insurance to all brokers, following strict guidelines irrespective of what company or individual is purchasing the policy. The premium is the same across the board and is dependent on the cost of the property and the deductible amount selected. I purchased a year’s coverage for a little less than $1,500.00. BOA purchased the same policy for $7,234.65.
2. It is unheard of for any insurance company to back date any policy. In other words, I cannot go to any insurance company, purchase insurance on 10/18/2011 and asked them to backdate the policy date from 06/6/2011. This is fraud.
In January, I sent a copy of the Windstorm Policy to Bank of America. Bank of America acknowledged receipt of the policy in February. They also informed me that I still owe them $4,618.65 for the coverage from 06/06/2011 to 02/10/2012. By this time, BOA has rejected my payments for January and February 2012.
On February 16, 2012 I sent payments to BOA this time by overnight recorded mail.

BOA increased the mortgage or escrow payments of $87.00 without notifying the customer of the increase. I had set up online bill pay for monthly mortgage payments of $1784 per month. BOA did not apply my funds towards payments and put all my payments on the side. Then they claimed that I did not make any payments and threatened me with foreclosure.
When I told them all of the payments I made, they said they did not apply it and put it on the side. They did it for 2 months and then they charged me late fee. The escrow had enough cushion to cover the increased escrow payments, but they did not apply that either. In spite of making all these ad hoc things, of not applying the payments and not explaining the increase in escrow, they sent the issue to collections department . Collections treat customers as if they were broke and were rude, without clearly understanding the issue. In all, BOA wants to bulldoze its good customers and treat them really bad.

BOA does not know its right hand from its left hand. The short sale division has rejected an all-cash buyer, even though the deal worked all of the way up their food-chain. The reason they gave, was because the buyer wanted to use her IRA, and in order to do so, the deed had to be in the IRA servicing company's name, as well as the buyer's. They said that the investor would not allow it. The investor (Freddie) said that it was BOA's decision. This is only one example of their incompetency. I suppose they would rather have this house go into foreclosure, instead of a stronger short sale price (this makes another great, corporate decision).

My husband (at the time) and I purchased the home in 12/2004. We divorced in 11/2005. I was awarded the house in the divorce as long as I refinanced it into my name, solely. I did refinance in 6/2006, into a 5/1 interest only ARM. Things were going very well, until I was laid off from a mortgage company in 9/2007. I only received $800/month for unemployment and did not find another job until nearly 12/2007, making $20,000/year less than at the mortgage company. I had credit cards, a car lease payment, the mortgage, and other standard bills. I had to use savings I had just to pay the bills and put food on the table. Subsequently, I used credit cards more than I should have, but was left with no choice.
Then, in 8/2008, my fiancé at the time, beat me up, doused me with gasoline, and more or less tried to kill me. I ended up in the hospital. My insurance did not cover all the medical bills, so I had to pay for those. I also had to retain an attorney to represent me in the case against my now ex-fiancé. That cost me several thousand dollars. Time went on as I struggled. I discovered I may be eligible for the government's Home Affordable Program. I inquired about it and applied for it through Bank of America in 6/2009. Finally, in 9/2009, I received a letter and a new mortgage note stating I am eligible for the program, but I have to complete this 3-month trial payment period. So for October, November, December 2009, my payment dropped to $996.96. It was $1236. I also have a second mortgage with CitiMortgage for $165/month. I made these three payments on time, and in full.
January 2010 came around and still no word from Bank of America (BofA) as to whether or not I was actually 'approved' for the Home Affordable Program. I made my January and February 2010 payments in full, rather than the trial payment amount. I called BofA at least once every two weeks to check the status of my modification. I was told that I didn't have to make the full payment, and that the trial payment was fine until they came to a decision on the modification. So my March 2010 payment, and so on, was the trial amount $996.96. And I continued to call about every two weeks for a status check, always being told the same thing, "your file is still in review", or "your file is still in underwriting".
I was struggling to keep my finances together. I had to stop paying my credit cards just so I could afford the mortgage. I wanted to keep the house no matter what. Wanted to keep a roof over my head as I felt the credit cards were not as important as a roof and food. I had no other choice but to start bankruptcy proceedings in order to make sure that my wages would not be garnished by the credit card companies or be hit with a judgment. I met my bankruptcy attorney in 7/2010 and stopped paying my credit cards altogether. Finally, in 12/2010, right before Christmas, I receive a call from a BofA representative: "Your file has been denied for the Home Affordable Program, but we may have another program of our own that you may be eligible for. But we can't start you in one of our other programs until you are officially denied the Home Affordable Program. And you should receive this denial in writing within 30 days."
Meanwhile, I contacted our local news station, 9 News on NBC. I told them my story and they offered to step in because many others in my state have experienced the same with BofA. They did contact BofA and had a 'client advocate' (Carrie) call me once a week with status. She never gave me anymore information than if I just called them myself. The only thing different was that I didn't have to wait on hold for 30 minutes just to talk to a live person. Anyways, I did not receive this denial of the Home Affordable Program until mid 2/2011 (well over 30 days). In the letter, it stated I was denied from this program because my loan had been paid off in 8/2009. Well, of course, this information was completely false! The loan had in no way been paid off or reduced or anything! The letter stated that if I wanted to contest this denial, I should do so within 30 days. Of course, I contested this. Carrie, the BofA representative, acknowledged that I was correct, that my loan had not been paid off. I was then told that my file would be re-considered for the Home Affordable Program. I waited until May 2011 to find out that I make too much money for this program. They were stating that I bring home, or net, $3100/month. I reviewed all my paystubs and bank statements and discovered that since I've had this current job, I've never brought home more than $2700/month. Even the representative, Carrie, agreed with my figures! So I re-sent BofA updated paystubs with a letter of explanation regarding my income. They told me I was still denied because I make too much money.
In May 2011, I received another letter from BofA stating that even though I was denied for the Home Affordable Program, I could still apply for some other modification through BofA. They need me to send paystubs, bank statements, a letter of hardship, basically all the documents again. So I sent everything in. Then, in June 2011, I received a call from Carrie stating that I should not have been denied for the Home Affordable Program and that they want to put me through that wringer again before trying to get me into one of their own modifications. So Carrie asked me to send my documents again, which I did. She also instructed me to make at least the principal and interest payment, which came to $1061/month. So I started paying that amount, and sent my updated paystubs and bank statements every two weeks.
I never heard from Carrie after this point and have left her several messages to call me back, but she never has. On 7/1/2011, my ARM adjusted. Since mortgage rates are so much lower now, it went down to 3%. My new P.I.T.I. payment is $1121.01. So I started paying that amount as of 7/1/2011. Meanwhile, I filed with the court Chapter 7 bankruptcy on 7/8/2011. Unbelievably, on 8/22/2011, I received a FedEx from BofA stating I have been approved for the Home Affordable Program. However, the deal is actually worse than what I'm paying now or ever was paying. The new proposed payment, starting 10/1/2011, will be $1240.65 at 4.5%. In 2015, it will go up to 4.75% and the payment will be $1264.76.
I understand that this is a fixed rate versus my current ARM, but it does not help me at all to increase my payment now. I'm barely making it by as is; now they want me to pay $120/month more? And this is more than what my payment was when this whole thing started. This deal is totally unacceptable. I've decided to stop paying altogether both mortgages. I need to start saving for an apartment, because now that my credit is destroyed, I will never qualify for an apartment unless I pay all the rent in cash up front. I did not sign any re-affirmation of my mortgages during the bankruptcy proceedings and my bankruptcy attorney tells me I can just walk away and let them foreclose. Frankly, I'm exhausted from this whole process. My life has been completely on hold for two years, and I'm ready to start 'anew'! I know some people who have their mortgages with other banks (other than BofA) and they were able to get modifications in a somewhat timely manner that actually did help them out. Again, this modification offer is no help, but a slap in the face. I don't know if there's anything anyone can do, or if it is even worth my time, money, and effort.

I am not kidding. Our family has been held in loan processing hell for three months! We began our honest journey on November 30, 2011. Today is February 16, 2012. Again, our loan is being delayed due to excessive paperwork issues and "conditions not yet met". Mind you, my husband and I have fantastic credit and the loan we are seeking is way less than what we were "pre-approved" for. We send in paperwork. It sits around at Bank of America. We call to ask why the hold-up. They suddenly decide to review the paperwork. They need more information. We send it in ASAP. It goes to the all-mysterious underwriter who sits on it for a very long time. The paperwork comes back.
Bank of America doesn't call. We call them, asking "what is going on" because we don't know. Oh! They need more information. This goes on and on and on. Bank of America will make you feel like a dirty criminal. Bank of America will treat you and your spouse like liars and cheats. My husband and I are honest people who live with honor and integrity and I deeply resent the implication that the information that we have submitted (and it has been lots and lots) is untrue. Be warned. Even when you do call, you will not get through. You can expect to leave a message. Do not expect a return call, not even as a courtesy. I feel that Bank of America is completely incompetent and fails (epically) to treat its customers with respect. After three months, with numerous documents submitted, there's no clear end in sight. I don't know what to do. Starting over is not an option for our timeline. Avoid Bank of America. Avoid them like the plague.

I have two mortgage loans with Bank of America. These were originally Countrywide loans, but became serviced by BofA when Countrywide was dissolved. My credit score is over 700, and I work very hard to keep it as high as possible. For over four years, my mortgage payments have been made automatically each week through a PayPlan 52 program that I subscribed to in 2007. The draft for the amounts owed comes automatically out of my checking account at Key Bank. I have an overdraft line of credit that is tied to my checking account. Currently, it is only about 1/3 utilized.
In May 2011, I became unemployed. I called BofA several times in June and July 2011, to inquire about their loan modification/forbearance options. I found the phone representatives to be polite, but not particularly helpful. At some point, I was asked to write a letter of hardship to an Elenora ** at BofA. I wrote the letter, submitted it as asked, and never heard a response, despite several follow up calls. In mid-July our unemployment insurance and some state aid began coming in, so I decided to discontinue my efforts to seek forbearance with BofA. One rep had explained that the forbearance process basically meant that, while I wouldn't have to make payments for a predetermined amount of time, that eventually all the payments missed would be due in a lump sum. I told her that there was no way I could afford to make a lump sum payment like that. I never heard from BofA anymore, until November 2011.
On November 11, at 4:08 PM EST, I received a call from a David **, a customer relationship manager of Bank of America. His call originated from phone number 877-452-4516, and was directed to my cellphone, **. David identified himself as being with BofA, and wanted to speak to me about my mortgage on ** Kettering, OH 45420. I told David that I was at work, and that I did not appreciate the way in which BofA has dealt with me as a customer, since I contacted them in June 2011 with concerns related to becoming recently unemployed. David must have been aware from my file that I attempted to contact BofA at least half a dozen times throughout June and July 2011, to seek forbearance. In my conversations with BofA representatives during this time frame, I found BofA as an organization to be insincere in its stated goal to be of assistance to persons, such as myself. I felt that my attempts to work with BofA representatives were frankly a waste of time. I decided to simply continue paying the mortgage on a weekly basis, as I had been all along.
Along comes David **, three months later, calling out of the blue, wanting to talk to me about my mortgage. Based on my previous experience with BofA, I had little confidence that David would prove to be any different from any of the other BofA reps that I had talked to. I got angry talking to him, not because of anything David said or did, but because of his connection to BofA. I don't have time to go through this all over again, with another one of your reps! I wasted valuable time this past summer with six different reps, and wasted yet more time trying to work with Save the Dream. I am tired of producing all kinds of personal financial documentation for so-called mortgage relief programs, and then being ignored. I am a full-time student, holding a full-time job, and I don't care to be strung along. Like I said earlier, I decided just to leave it alone and continue paying the mortgage as I had been, through the PayPlan 52. I did tell David that once I got back on my feet, I fully intend to refinance my mortgage with a different company.
Two weeks later, I receive a letter in the mail stating that my PayPlan 52 has been suspended, because the last draft was returned unpaid by your financial institution. Up until now, mortgage payments have been an automatic procedure every Friday. After I set up the PayPlan 52, I had nothing more to do with it. The debits have been automatic. I have also never had an issue with Key Bank performing the debit, as they have been doing it for over four years. The balance in my account has always been sufficient to cover the debits, so that was not an issue either.
I then checked the online statement from my checking account with Key Bank. Coincidentally, the debit on account **, which would normally have occurred on Friday, November 11, did not occur. Neither account was debited on Friday, November 11, as I would have expected. On Monday, November 14, a debit occurred but only for account number **. Then, on Friday, November 18, this happened again, only account number ** was debited. My concern, therefore, is whether Mr. ** has reacted out of spite to my angry rebuttal of his services on Friday, November 11, and chose to somehow create havoc with my PayPlan 52 account, which has resulted in the inability of payments to occur on account number **.
Please look into this matter at your earliest convenience, as I am quite certain that something like what I have suggested has indeed occurred. I am prepared to seek legal counsel if necessary in order to resolve this matter. My credit history in general, and with BofA has been excellent and I will not suffer the consequences of spiteful behavior on the part of one of your representatives.

I am losing my home. Bank of America messed around with me for eight months. They kept changing the sale for three months always promising to help. No cooperation. Getting letters from them telling me to call them and when I called they never returned my call. I called five times in one day and never a response. Now they tell me I do not qualify due to the fact that I make $200 per month too much. Huh! It took them 8 months to figure this out. The reason all of this started was due to the fact my fact my wife and I were both laid off from our jobs at about the same time. We contacted them immediately to inform them of the situation, discussed loan modification and then said I had sent my info back too late. Not true. I sent it certified mail. I have the receipt. Bank of America does not know what its left hand is doing from its right hand. They need to be made accountable for what they are doing to people. I need help immediately. Please respond ASAP.

My husband and I both have excellent credit scores, which are both over 800. We also have more than enough liquid assets to be able to cover the refinance that we requested from Bank of America. BofA made us provide them with an extensive amount of paper work, which they should already have had since our current mortgage is with them. It was originally with Countywide but was transferred to BofA. At the last moment, we were turned down because they told us that our debt to income ratio was too high. Not only did we have to pay $435 for an appraisal that was way low (and, if I was selling our home, I would have had to appeal), but in our case our home still appraised three times more than we were requesting the refinance for.
Our current rate is 5.5%, but the new rate they quoted us for a 10-year mortgage was 3.5%. The loan officer that turned us down told me that they would qualify us for a 30-year mortgage, and my payments would be $500 a month less. Now, just why we would be able to qualify for the 30-year, but not the 10-year? The only reason we decide to do this whole process was because we wanted to have a shorter term with a lower percentage rate. We currently have only 11 years left on our mortgage. The first loan agent said that we would save 30K if we refinance at the lower 3.5% rate. The 30-year also has a higher percentage rate, almost 4.0%. This is just unacceptable for them to use this bait and switch tactic.

I am a struggling homeowner, we had 2.5 incomes, my wife worked full time and had a thriving consulting business. Now we have 4/5 of one income. Recently, my hours were permanently reduced. My wife tried to call BofA to find out about the program and let them know our payment for the very first time (12 years of same mortgage) would be late.
They would not let her even talk to someone, said she wasn't on the account yet I have paperwork showing I already gave her access years ago at Countrywide, when our loan was transferred back then. We have both had the loan for 12 years and have lived in the same home. I called to give authorization, but then they told her that was just for refinance not loan support. When we tried to get help for the late fee, they said she would have to call back after the payment was received, even though she would not be authorized to talk unless another form was faxed.
Meanwhile they could not help us with refinance, even though our home is worth more than owed, we need 60% loan to value, they wanted over $5,000 to refinance, when Union-Plus would do it for $1,500 flat fee, but don't offer the term length we need. Bank of America is using the refinance fees now to make money from consumers, they offered us zero help for our second mortgage, even though we are not underwater with our mortgages together.
This is another scam. I am so disappointed. I know there are others out there going through the same diversion tactics BofA is using on us. Nothing has changed with BofA operating practices as of today.

I began my loan modification paperwork in July 2010 with BOA. I gave them all the necessary paperwork. They assured me that I was complete and now I had to wait for trail payments. As our income was significantly reduced, we needed this modification as we foreseen a foreclosure shortly looming. Nothing in August or October and they were threatening us. Thus, we filed Chapter 13 in November 2010 to save our home. Our Chapter 13 was confirmed in January 2011 and amazingly in May 2010, we were notified by BOA that we were approved for loan modification and our trial payments would begin in July 2011. This causes issues when you're in Chapter 13 because the court has to approve the modification and they have to allow the payment to come out of the plan. What happened is that the court approved the modification in October 2011, yet failed to inform us and BOA did not inform us.
However, our trustee stopped making payments and it was at the end of the November 2011 that all of a sudden we were informed we had to make the November payment that was due November 1 and December 1st payment was just a few days away. This was our "Oh No" moment because we did not know, did not have the money and were already late and in jeopardy of being tossed out of the modification plan. Struggling with the attorney and the trustee, we were refunded money from the plan in order to make November's and part of December's payment. Next was weekly calls to BOA complaining about not getting a proper statement: "If the modification was confirmed in October 2011, why is my statement not reflecting such?" Still no change until Feb 2012 when we finally received the final modification paperwork and a correct statement. It's done and this we are happy about. Why does it take 18 months to do this? All my calls to MHA and BOA assured me that it would take no more than six months. Why does it take a Chapter 13 case for BOA to say, "Oh, well, maybe they do need their loan modified"?

BofA bought out our loan company. We have never missed a payment. They started out by saying we were 3 months behind. After fighting with them for 4 months, they found 2 payments that were missed. Now they say we are 1 month behind. After many calls and 2 yrs later, they still cannot give me a date for this missed payment. I have bank records of every payment made. Contacting Customer Service is a like talking to the wall. Every time I call, I get a different answer. Even their own payment history shows all the payments being made. Maybe a $30 million dollar Law Suit will wake them up.

I made an offer on a house that's on short-sale through Chase Bank. Both I and the seller decide on an offer which was accepted and a contract was done. After 1 month, the lender did an appraisal and it came back more than the offer. Chase denied my offer because of the appraisal, how is that my fault. I think that was so unfair to me and my family, please help me.

We are currently in litigation against BAC/Fannie Mae in US District Court to have our foreclosure overturned and attempt to have BAC reinstate the mortgage and work out a long term modification. However, last week, BAC filed a motion to dismiss our compliant, process with the eviction process and force us to pay BAC all interest, fees, etc. including their legal expenses if BAC prevails in court. In my mind, BAC and Fannie Mae had absolutely no intention of working with us on the reinstatement or modification. We have been dealing with this for over three years now. We are going to fight this motion and continue to fight to keep our home. Is there any information on class action suits against BAC that we can look at and possibly enjoin?

I am paying on an underwater mortgage. When I refinanced 3 years ago (my account was sold from Countrywide to B of A), B of A slapped me with monthly mortgage insurance of $185 a month, only to be added to their inflated coffers! I would like to raise attention to my situation, as, there are probably others in the same situation. I have impeccable credit history, have never been late on a mortgage payment, and even make additional payments toward my principal. I am not at risk of foreclosure. However, there are no rewards for me. I have finally succeeded in finding another lender who is not requiring mortgage insurance.
I would like to suggest that Bank of America be obligated to pay back to me the total PMI required by them. Anyone out there in the same circumstance and willing to investigate the possibilities, persuade the appropriate legal authority? I believe our situation deserves analysis, and be brought to the attention of any interested legal party reading this comment.

Do not ever consider short selling your home until you read the following:
When we bought our home in 2006, we were pre-qualified for the loan. But when we went to sign the paperwork, Countrywide wrote the loan up as a 1st loan and 2nd loan. We asked why and were told that to help us qualify for the loan they needed to break it up this way. We never missed a payment but due to my husband losing his job, we sold our house on a short sale May 2010 with the 1st loan paid off completely and part of the 2nd loan. Obviously, because of the short sale status, we still owed about $60,000 from a $349,000 loan. Our credit report stated that both loans were closed.
During the past year and a half, we would occasionally receive notice from BOA that we owed on the 2nd loan. Every time we called BOA we were told that BOA Short Sale Department was a few months behind notifying the regular Mortgage Department but not to worry. We finally called them in January 2012 and asked once and for all to fix it. Their reply was they would be happy to if we would send them the original escrow paperwork which we did. We called them the next day to verify they received the paperwork and we were told that they no longer had our files and our loan had been sold. We asked them how they could sale a loan that was closed. They again replied they could not help us because they no longer had our records.
The next day we received a phone call (no previous notice) from Greentree (by the way this company is owned by Bank of America) demanding payment in full for the full amount of the 2nd loan. We told them that this home loan had been closed on a short sale. Also, the amount of the sale on the 2nd loan was the wrong amount because part of the loan was covered on the home sale. They said they couldn't help us on the amount of the loan and told us to call BOA to find out about it. We tried to contact BOA again but they will not talk to us. We were lied to for a year and a half with the line that there was a communication problem between departments and they would fix their records as soon as they received the paperwork from the short sale department. We moved out of our home over a year and a half ago so how can they reopen our loan and demand full payment? I am convinced that everyone that works for BOA receives training on how to lie and to deceive the public.
So here is a company that was bailed out by our government for billions of dollars and then are now turning around and demanding payment in full and or terrorizing families. When is BOA going to pay back their loan in full? How can they get away with their fraudulent policies? Why is our government not investigating them? I thought our President promised a new working policy on our housing problems. There are hundreds and maybe thousands of people with similar stories. Who do we turn to for help?
My advice to anyone who might want to short sale, don’t. Check your state for laws concerning business laws. If your state allows companies to attack people in this way, find out why they don't change their laws.

I was a BofA mortgage customer, generally happy, and contacted them about refinancing my mortgage. The mortgage rep I was sent to asked me for a lot of information, much more than necessary. They not only asked for my 401K account balance, but wanted a statement of what my account is invested in! They asked me for a credit card, on which they said they would place a "hold" for $450 to pay for the appraiser who would come to my house if I moved forward with the application. I gave the rep my credit card number (I figured, after all, I was already doing business with BofA for my current mortgage). After speaking with my husband, I contacted the rep two hours later and cancelled my application. He confirmed that the hold of $450 on my credit card would be released. This was on December 5th, 2011. However, they did in fact take the money from my credit card. It was not just a "hold". It is now February 12, 2012 and despite many calls, emails, and escalations, this money has not been refunded to me. Needless to say, I refinanced with another financial institution and will not be doing business with BofA ever again.

We procured the loan for our house in 1996 from what was then Nations Bank. I was told that I could expect to pay the $50/month PMI for 'about' 2 - 3 years. Three years later, and after Bank of America had absorbed Nations Bank, I was told that I would have to keep paying the PMI until I had paid off a much higher percentage of the loan value. I ended up having to pay PMI for 10 years resulting in Bank of America stealing about $5000 of my money that would have gone toward my principle. Only when I threatened BOA with legal action did they finally drop the PMI. I am still considering legal action, and can promise the civilized world that I will never again deal with Bank of America once my loan is paid.

I'd paid on my home for fourteen years (1996 - 2010) and I had only six remaining years owed when I lost my job in October of 2008. In the interim of looking for re-employment, I had some income but I was short in my ability to pay my mortgage by only a few hundred dollars. I wanted a loan modification and I did not foresee a problem. After all, I had paid for fourteen years. This began my nightmare with BAC. I was told by a rep that I had finally got a hold of BAC, that if I could make up the shortage, then they could help me with a loan modification. Of course, my response was that if I had the additional, I would not have the need to call them in the first place! The ineptitude!
I, like all the many that are posted here, ran into problem after problem with Bank of America. Mine was a CountryWide loan bought out by BAC. I made call after call for a whole year! After one rep out of the few that I could get through to on the line instructed me that I should contact the Morman Church and see if they could help me, I took off for the nearest CountryWide office in my area and demanded assistance. The loan officer, who offered to help and who had been instructed by BAC not to help any customers accept with new loans, put himself on the line for me and for 2 hours straight. He on his business lines (he actually used two phones at once!) and I on my cell phone sat together calling BAC for assistance only to be transferred from one department to another. Even he with his affiliation with the company could get nowhere!
Down to the wire and within two weeks of foreclosure, I finally got a hold of someone who agreed that I qualified for the modification and they sent me the paperwork. What should have been overnighted was days and days to get to me. I filled everything out and faxed all of the paperwork as instructed. Nothing happened! I fell right back into the nightmarish attempts to speak to anyone! I fought tooth and nail to keep my home of fourteen years and in January of 2010 it was lost to foreclosure. I found my new job the next month, in February of 2010. Bottom line, I was robbed and it was my home that was stolen from me. They took all of the equity that I had built up and more, so much more. They turned around and sold it immediately. What happened...Bank of America's act against me was a crime in every literally sense of the word.

Where do I begin? I re-modified my loan in 2009 with Countrywide who sold it to BOA. The way the note is written is that I am to be charged 3% interest rate from April 2009 to April 2011. The rate goes up to 4% from April 2011 to April 2013, then my rate will go up one more time to 5% in April 2013 and cap off at that. BOA charged me 3% from April 2009 to April 2010, then my interest rate went up to 4% from April 2010 to March 2011. My interest rate went up to 5% as of March 2011. Clearly, I have been overcharged and there has been a breach in contract. I brought it to the bank's attention and I keep getting the runaround by them. They won't let me speak to a supervisor about this matter and there is no record that I have been calling.
The bank owes me over $5,000.00 in overcharges and says that they can not give me that money back in cash. It will be put towards my principal. I am fed up with these people. Every time I call, I get transferred around 5 times. Each time, I have to explain the situation. When they say that they will call back, they never do. I am over, Bank of America. I want out of my contract!

First, Bank of America increased my escrow payment by $300 even though my taxes were going down the following year. I had to argue and argue with them to get them to reduce it and give me the extra money they were accumulating in my escrow account. I eventually got a check for around $1600 and my payment lowered, but not after hours of time on the phone with them.
Now, I changed banks for savings and checking (neither was BoA) and so I needed to change my electronic debit for my mortgage payment. The first payment came out of my new account on a new date that I picked just fine. However, the next payment came out of my old account (at the new time) and caused an overdraft fee. I called Bank of America and they told me they had no record of me changing my information, even though the previous payment came out of the new account and they were both on the new date. After giving her my new account info again, I asked for my money back for the overdraft fee. She told me I would need to mail my bank statements from both banks to their complaint department. Why should I have to provide that much information to them to correct their mistake? It is not their right to have access to my bank records!

I believe that Bank of America who bought out Countrywide home loans has dishonest business practices. I have made numerous attempts to get a loan modification through Bank of America and have been continually advised that I need to resubmit my paperwork or that they have no record of my requests. This happened on 7 different occasions. When I signed for my first and the second mortgage, my combined monthly payment was $3200.00. My monthly income was $4500.00. At that time the mortgage was held by Countrywide and was later bought out by Bank of America. I was assured by my Countrywide rep that this payment would be temporary, that it was just to get me into the house and that I would be eligible within 6 months to refinance. In addition, she said when that time came, Countrywide would combine the 2 loans for a fixed percentage rate and the combined payment would be around $1600.00 including my property taxes.
I contacted Countrywide (which was now Bank of America) within the 6 month period and was told that I did not qualify for a refinance because I did not make enough money. I attempted to ask for a refinance on another 2 occasions and was told the same. I continued to struggle to make the very high monthly payment for a couple of years and was given no help by the mortgage company. As the economy continued to spiral downward, Bank of America started to advertise loan Work-outs that would allow borrowers to lower their monthly payments. I sent in the paperwork on two separate occasions. I was told when I called to follow up the first time that I was denied. The second time I was told that they had no record of my paperwork being sent. Those documents were sent by FedEx with a signature return receipt that I did receive.
I sent in my paperwork a third time and was finally offered the work out. Bank of America offered to let me skip one payment and then they would raise my subsequent monthly payments by $150.00. This was not what they advertised for this program. I denied their offer and made my regular payments. Finally thanks to the Obama administration, the banks were forced to offer loan modifications to struggling borrowers. The first time I sent in my request for a modification, I was told that I wasn't behind enough on my payments to qualify. Over the course of the next 2 years, I submitted another 7 requests. Each time when I called to follow up, I was told they needed more information. I sent them the additional documents and was told upon follow up that my request either expired, or they had no record of my requests. I have spoken to numerous other borrowers who have mortgages through Bank of America. They all state that they have been subjected to the same stalling tactics and run around. I believe the promise I was made for a refinance when I got the mortgage was fraudulent as they had no intention to ever give it to me. I also believe the loan modification stalling tactics are fraudulent.

I just wasted 1 1/2 hours with Bank of America trying to set up twice monthly payments. Over the course of this time I was transferred 4 times, gave out a huge amount of personal information to each rep, and disconnected once after supposedly having everything set up when I was transferred to another rep for confirmation. This was a supervisor that disconnected me. I had to call back again and go through the whole process again and transferred two more times, only to be told that I could not set up the plan because it was a month ahead and would have to go over everything yet again in a month. Please. Could they not take down the information and save it for 30 days? Also, it took a lot of rig-a-ma-role to even hear a human voice in the first place. I would highly recommend not going with this mortgage company.

Refinanced home in 2008 with Countrywide and then the loan was sold to BofA. No new deed was ever filed with county. I was told by county office that we will not be able to ever sale our home because a new deed was never filed! Our documents were filed with MERS! All other homeowners need to check with their local county office to verify your deed was recorded properly! Could be the reason for all the denials of loan modifications and delays of foreclosures.

We have two mortgages with BOA, one being the primary, and the other, the second. Both mortgages were approved for the Home Modification program. We were given a Loan Modification counselor named Andrea **. She is the one we have to talk to about everything, and anything about our mortgage. Since being approved for Home Mod., there were two separate instances. Our first mortgage (primary) was put to our second mortgage. so, it showed that we missed our mortgage payments. The one past occasion was taken care of over the phone, and put into writing, of what happened and was corrected. My wife made another payment to the first mortgage on another occasion. She gave them the correct account number, and all was good.
We received in a matter of a month three different Home Mod papers again for our second mortgage. Finally, we realized that the payments reduced significantly, so we figured again that our first mortgage payment again was paid to the second. When my wife called, that was exactly what had happened. On December 8th, 2011, both my wife and I were on the phone with our Home Mod counselor Andrea, and an accounts payable person. The discussion was to move the first mortgage payment from the second to the first, so it seemed like we were up to par. We were told by both Andrea and the accounts payable person that the problem was going to be rectified. After receiving yet another FedEx package from BOA, regarding another lower payment, we called Andrea again, who is the only person we can talk to regarding our mortgage, and we left several voice mail messages, with being told at the end of Andrea's VM message that we are to be given 24-48 hours for her to get back.
We got absolutely nothing. After repeatedly calling, my wife finally talked to her. She was told by Andrea not to worry, and that the problem was going to be fixed, and to give her a week, and she will get back to us. Again, nothing. We called repeatedly, and left several voice mail messages to her, and then talked to customer reps. We asked the customer reps to put us through to her supervisor. They said they put emails to both Andrea, and her supervisor with her supervisor to call us. Now, in the meantime, we are now receiving letters, and phone calls about the short sale of our house, and what we need to do to short sale our house. We can make our payments, but when no one gets back to "help" you, what can you do? We need to get this problem corrected, so we can stay in our home. Bank of America is not really a "bank of America".

I purchased a home in 8/07, in the amount of $114,000.00 and was told my payment would be $750.-$800.00. My payment ended up being $1,267.00. My loan was sold to BOA. I lost my job in 2010. I asked BOA to modify my loan. They did, and my payment was down to $1,067.00, but gave me 40 years to pay (480 months = $512,160.00). Who in their right mind would pay this amount for a 1425 sq.ft. house on a cement slab. I asked why the payment was so much. I was told I am paying $285.00 PMI. Why do I need to pay a lender's insurance? I will do everything I can to keep my house. I will write to everybody, and every congressman I can to fix this problems.

The dispute with Bank of America mortgage modification resulted in my wife posting on her Facebook, a letter begging anyone for help. Bank of America actually called us. The first time in two months. It was their social media department. They had seen my wife's plea. They promised to help get it resolved ASAP. The next day, my wife's Facebook account disappeared. That is how we communicate with our clients. We are a small business, and now we are destroyed.

I own a home in Riverside, CA that I purchased in 2005. This loan was principal and interest. I have always paid for taxes and insurance myself. I have never missed a payment nor ever been late on a payment. Last April my statement came in and the payment was approx. $700-$800 higher then it always has been. I immediately called Bank of America and found out that BofA changed my account to an impound account.
Fast forward today and 75 plus contacts to Bank of America later. This problem has not been taken care of and the issue has increased. I have continued to make all normal payments on time each and every month. Of the past 10 payments BofA has cashed 3 of them and sent me back Bank of America checks for the same amounts, BofA has sent back 4 of my payments uncashed attached to a letter. Bank of America has put my house into foreclosure for not paying. Bank of America has absolutely destroyed my credit form high 700's to low 600's. As a result of my lowered credit, Bank of America closed several credit cards, lowered the limits on my other cards significantly. Other credits have lowered my limits when they did their normal credit updating. Citibank lowered my credit $30,000 on one account alone.
I have all paperwork for the past year. I have a letter from Bank of America admitting they made a mistake switching my account to an impound. They are attempting to fix the problem, but I made it very clear in writing to them that I want on their letterhead a clear, precise detailed listing of what they will fix for their mistake. To date, BofA I have not received this letter. There are many other items that have happened, all documented. I want to go after BofA for damages and punitive damages.

In February of 2009 I appealed to the attorney general with regard to refinancing difficulties I had with Countrywide Home Loans. In May 2009 my loan was taken over by Bank of America. In August 2009 I entered into a trial modification with BOA. On March 30, 2010 I received a letter stating that I qualify for a permanent modification. A few months passed and I did not receive any documents BOA claimed they would send.
There are too many inconsistencies with BOA. I have sent the same documents several times at their request. On October 8, 2010 I received a phone call from Emily with BOA stating, “”It's not in the best interest of the investor to modify the loan.” Throughout the 16 months, I was sent letters encouraging me to continue making my payments in the amount of $1080.35. I was not informed of the fees that were imposed on my loan nor was I informed that these lower payments put me several months past due. I was not informed that my credit score would be affected negatively. BOA reported to the credit agencies that I was past due making monthly mortgage payments, which was not correct.
On June 10, 2010 I faced a tragic loss with the death of my father. On his death he left my sister in charge of his estate. I borrowed money from his estate to avoid foreclosure. On November 3, 2010 I electronically paid $20,093.25 to bring my loan current. The monthly payment amount before the trial modification for principal and interest was $1,647.02, I was responsible for the escrow. The trial modification payment was $1080.35. This was a savings of $566.67 a month under the trial modification. If we take $566.67 x 16 months, we get a savings of $9,066.72.
According to BOA I owed double that amount to bring my loan current, this is where I start my research. I would like to join a class action lawsuit or start one in Connecticut with your help. I have kept excellent records and all correspondence with BOA regarding the modification. I am aware there are several other people in this situation. BOA still owes me money and I feel strongly that they follow through with the original modification as well. The Bank of America has neglected to return money once my loan was paid in full after the HAMP fell through.
Bank of America has not been cooperative regarding this issue. I have pleaded my case repeatedly and I received a check on February 17, 2011 in the amount of only $173.90 for escrow BAL refund. BOA is covering their error at my expense. They currently owe me $786.44; this amount may seem insignificant however I assure you that this dollar amount surpasses my weekly income therefore it is most important I follow up on this.
I have since refinanced my home, however not to the degree that BOA would have. My payments I had with the modification would have been significantly lower than they are currently ($1360.64). This is what I am looking for, completion of the original plan. Please help us fight for the injustice against the taxpayers who bailed out the very bank that violated our trust.

After two years of trying to negotiate a modification, or get any kind of help with my upside down mortgage. Bank of America sends me a letter, assigning me a "dedicated customer relationship manager" who, according to the letter, "wants to help me determine which of their programs will help me in this difficult time with my home loan". I'm 10 days away from my foreclosure date you lying **! The second time I was denied a home modification it was because I "didn't have enough in savings, to make up for my missed payments!" What? If I had more money in savings, don't you think I would have used it to keep up with my payments? Once my nightmare of home ownership is over, I will never ever have anything to do with Bank of America again. Stay away from big banks and give your business to local credit unions and small banks. It is the only way we are going to be able to save ourselves from federally subsidized banking corporate greed!

We are very unsatisfied with Bank of America being our mortgage lender. We, like many others, purchased our home through Countrywide and was turned over to Bank of America, not by choice. Today, we noticed that BOA had took two payments out of our checking account instead of one. So we called them. After my husband was on the phone with them for almost an hour talking to who answered the phone, an account analyst and a supervisor, we had gotten a list of chores for us to do to correct their mistake. We were told to fax them a bank statement showing both payments and two NSF fees that were caused by the extra payment coming out. Then we would have to file two separate requests, one to refund the extra payment and one request for BOA to pay back the NSF fees. Plus, get our bank to write a letter to BOA stating they would not refund us the NSF fees, also because they wanted to make sure we didn't get refunded twice.
Before all this happened tonight, let me tell you about the beginning of our problems with BOA. I had surgery December 2010. I fell behind 1 payment and couldn’t seem to get caught up. BOA would send me a letter telling me I owed a certain amount, and when I would send it in, they would send me a partial refund. Anywhere from $40-$140. This happened, I believe, 4 times. Tonight, as my husband is talking to them, he is told that they added a $30 charge each time they sent a refund check. And on top of that, they have charged an extra $15 inspection fee for any month we did not pay on the due date. We were told an inspection fee was for "someone to come out and inspect our property to make sure it wasn't burnt down, etc." Keep in mind we were only behind 1 payment, but it took a while to catch that 1 payment up. I have never seen a financial business that tried to ruin their customers’ credit and would not work with their customers! I want to refinance with another company, but can not afford to pay closing cost to do so! I feel stuck!

We bought a new home (newly built) but it wasn't the first house in the neighborhood. Several had been here for a couple years already. Our escrow taxes were grossly under-estimated (by almost $200.00 a month). We got s bill for $1,991 due for back escrow last year and our house payment will be going up $215 per month from here on out. How is this legal? We could have lost our home. With so many other homes already built I don't understand how this could happen!

The following is my Bank of America nightmare that I live every day. I will try to document the facts that lead me to reach for help. Bank of America acquired my mortgage from Countrywide Home Loans. Due to the collapse of the economy, and the fall of the housing market, a trickle down affected my work as an Architectural and Interior Photographer in New England. I have not had an assignment, or worked in over three years. In September 2011, I applied for the Bank of America Home Modification Program, and was assigned a case manager. From my understanding through research and conversations with said case manager, the program is designed to help the homeowner, by lowering mortgage payments, making it affordable, and possible to stay out of foreclosure.
I faxed the required myriad of paperwork (my life history) to Bank of America more than several times. Each time I was told a page was not received. When, after a month and a half, all the documents were received I was informed the time limit expired and I would be required to start the process anew. I again submitted the many pages to Bank of America and weeks after told the paperwork went to Bank of Americas Underwriting Department. (Throughout the months I telephoned the case manager more than weekly leaving messages that were very rarely returned. ) When contact was finally established I was told my account was placed into a Bank of America Waterfall Program, and a grace period of six months was applied to help alleviate my financial burdens. Thus far, this has not been verified.
In late November, Bank of America informed me that the Bank of America's Underwriting Department accidentally overlooked my request for the Bank of America Home Modification Program, and my paperwork would be expedited ASAP. In December, I was told my case manager no longer was employed (in this position), and thus a new representative was assigned, and my state of affairs were again to be reviewed . Again, I left messages that were never returned. Frustrated beyond imagination, I contacted the heads of Bank of America's various departments. In January 2012, I was informed my case would take another forty-five (45) days! Enough is enough.
Reading articles and complaints about Bank of America, one of the largest corporations in the United States of America, they are the most horrific, horrendous company ever to bilk the citizens of this country. Not since the financial collapse and resurrection of banks and mortgage companies. More corrupt than Enron, AIG, Goldman Sachs, etc. The government has provided money to hundreds of banks, as part of the $700 billion Troubled Asset Relief Program (link: **). I implore you to look into the practices of Bank of America, seek and find those responsible, starting from the very lowly case managers to the top executives, who continue to ignore the very people who pay their salaries, and are in danger of losing their homes. I am a disabled, decorated Vietnam Veteran, and do not wish to live my life on the streets, shelters, or veterans' home.

I called to inquire about refinancing my mortgage under the HARP program. The mortgage person Christopher ** said that he needed my credit card number, so he could use it to pay for the appraisal if it was required. I told him that I was not interested in the loan with him and Bank of America. That day, he charged my card $450.00.

We lost our business last February and with only one income decided to do the loan modification that BOA offered. As of the beginning of November they had all my paperwork for review, said 4 to 6 weeks. I have been following up weekly ever since to only hear it should be a couple more weeks as they are behind. i ask when they will be hiring to catch up as we are going on 4 months now but no response. I am getting close to losing my house and would like a resolution and quick! My husband has been eagerly applying for work with no luck so I need a resolution fast.

We were steered to a countrywide loan in 2006 that is predatory in my humble opinion. In 2006, due to medical disability issues, I was not in a state of mind to understand loan complexity and long term ramifications (close to 300k). With great difficulty, we made $2,200 payment on disability and beginning teacher (translation, low pay) salary for me and my spouse.
In 2008, they notify us that payment needs to go up to $2,500 for what they said was increased property taxes. I said I could not pay that much. We started the Making Home Affordable program shortly after. First, they said no help needed as was current on all payments. Then I fell behind on mortgage and cc payments, they accepted loan mod program. We were set up on trial payment and perm 3 months after. We fulfilled that, and paid trial for 18 months. During that, we got the runaround, lost paperwork, transfer everywhere, etc just as others have said. Then, in Dec 2010 I was told no. The investor did not want to work with us. So we listed home with local realtor and for short sale.
One offer at below listing, Bank of America countered with higher that market fell through. Now, they are starting foreclosure. I have an attorney who will make case. The loan should not have been made due to medical condition and did not allow understanding. To add, I was not at closing but in a different state seeking medical treatment. They had my spouse sign for me under a power of attorney, something I did not and not understand. My spouse also is from another country and English is second language. DGWK. For those that mentioned Bank of America is like the devil. That is not fair. It is not fair to lump devil in same league. I believe he is more consistent and has his ethics. We at least know what we get. A Bank of America office should be a great place for a heart surgeon. A lot of people there like the Tin Man, no heart.

Hilarious! Bank of America are the biggest criminals. I just recorded a wicked conversation with one of their mortgage insurance division supervisors. They told me that they are recording my call but can't speak to me if I am recording as well or if I refuse to let them record. I never agreed to that before doing business with them. Good thing, I waited until he gave me his entire pathetic explanation of why their policy for check endorsement is not in my contract nor have I ever been notified of it.
Plus, I caught him lying. I then informed him I have been recording the entire time. He was furious. I see why their stock has tanked and they are closing up branches. I can't wait until they go bankrupt. I think I will file a complaint with the department of insurance and the Attorney General's Office and sending them a copy of the conversation, maybe email it to the news media as well! Sell your stock and close your accounts as these crooks are an insult to America! Someone please file a class action suit against these *** of society!

Bank of America bought my mortgage from Countrywide and has destroyed my credit by playing games with my mortgage. I went to Bank of American in April 2009 to refinance my home. My rate was 7.37% on a mortgage of $740,000.00. The appraiser compared my 7,000-square foot colonial all-brick home with a 3,000-square foot aluminum house. The appraisal came in at $700,000.00 (down from over a million).
Bank of America told me the only way I could lower my interest was by applying for Making Home Affordable program, which I did (many, many times re-sending in documentation). In the meanwhile, Bank of America stepped in and paid my taxes for me ($6,000.00 per quarter), which was not part of my mortgage. Bank of America then sent me a bill for $40,000.00. This crazy bill kept jumping every month. They changed my fixed rate mortgage from just over $5,000.00 a month to just under $9,000.00. After 18 months, Bank of America told me that I needed to pay them $120,000.00 to come current and that I had not paid my mortgage in 18 months.
I sent them copies of all my payments and proved that I had made my payments every month with the exception of the 2 months they told me a new modified load was completed and coming in the mail. I had my lawyers send them this proof of payment. In December, I received a letter that they were looking at the payments to figure out what was going on. In the meanwhile, I set up direct payments from my bank to Bank of America to prove to the judge (I want to get this in front of a judge as soon as I can.) that I have been paying every month.
Every month, Bank of America keeps sending me back my payments. It is clear that Bank of America is trying to stall/delay as long as possible, so people like me that pose no real threat of not paying will not have access to a lower fixed-interest rate.

I was one of the many thousands fighting for a modification, who sent the same documents month after month and week after week. I fought off foreclosure sales 4 times, was out of work and fell behind, then back on my feet with a good job and could well afford the mortgage. After almost 3 years I was told I was approved for a modification from BOA, and approximately a week later the house went up for foreclosure sale! No one bought it and the bank took it back. I did all I could to stop it, but a Broward county judge denied the request for postponement by BOA's attorney.
I was so close to possibly saving my home. If the bank's attorney is requesting to postpone, why can and would a judge deny? And how can the banks and attorneys get away with "the left hand does not know what the right hand is doing"? I feel that the bank should have to go back to their offer of a modification and reverse the foreclosure sale. Please help! My attorney says it is too late to do anything about this, but I think I am right.

I have made numerous attempts to do a loan modification. I have been denied a loan modification. The Bank of America had promised to help me within 12 months. Because they dragged their feet, I was unable to qualify for Emergency Mortgage Assistance with the federal government. The Bank of America has robbed my savings, check and investments. I have been experiencing a financial hardship. My husband died almost three years ago. I offered to pay $700/month. I am willing to pay my full payment if BAC is willing to take the arrears and capitalize back into the mortgage payment. Please have your lawyers get back to me immediately and work out a suitable plan so that I can stay in my home.

Bank of America bought our mortgage, which had been with Countrywide. After reeling from a year of I.D. theft, which BoA refused to do anything about and refused for seven months to let us close our checking account with them, they have started harassing us about supposedly being in default on our mortgage. Having previously tried to auto-draft our mortgage payment from the BoA checking account that we were trying to close (causing it to become overdrawn as we were using an account with a different bank), they are still trying to put us into collection for the amount they erroneously auto-drafted from the other account. The bank manager refused to give me anything on paper. That would all be bad enough had they not started in on us in December (2011) yet again.
In December, we began receiving overnight packages claiming they were from BoA and that we were in default on our loan. When we called the number to complain, the people answering claimed to be from a collection agency not connected to BoA, despite the paperwork we had claiming it was. Furthermore, when they bought our mortgage, they left my name off of it, keeping only my husband's. Despite requests to have my name added and for them to be allowed to speak with me on this account, they have not gotten us the paperwork. BoA also repeatedly drops the calls after transferring my husband several times so that the calls cannot be completed at all.
BoA finally told my husband that we were in default, claiming our monthly payment had gone up (we were not notified) and not counting our December or January payments. The second week of January they mailed us notifying us that we were in default and foreclosure proceedings would begin if we didn't pay roughly $3,000 immediately. No payment plan, just give us money now or lose the home. We paid to avoid foreclosure while still waiting for an explanation of why this extra money was needed. We've only gotten a vague phone explanation of higher taxes (which for some reason didn't come out of escrow) and a refusal to send us anything on paper.
One week later (Jan. 25), we received another slew of letters claiming we were still in default and demanding this time, $2,150. We paid yesterday, but have no explanation of what this was for. And once we called to pay, the amount was $150 more due to "late fees." We have nothing on paper, the local BoA Home Loans office tells us they can do nothing other than refinance in the office--we are stumbling blind here. And as our credit is now in bad shape due to the earlier "clerical error" that we are now in collections for, our ability to refinance with a local bank is rather damaged.
Yes, I would love for an attorney to contact me. BoA's fraud department not only cost us thousands of dollars but also took rather humiliating actions against me and my family. And now, they are refusing to even let us see any statements on our mortgage while sending us constant letters warning of foreclosure when we have managed to pay monthly--even through a devastating bank card theft/I.D. theft case. We've done nothing wrong!

I was requested to submit innumerable documents and financial statement in order to qualify for a modification on my loan. Less than three days after the deadline of my submission, which was submitted earlier than the requested deadline, I was asked for duplicate information. I was then notified I qualified and would receive a trial loan payment and then days later was told I did not qualify. I have filed all the appropriate forms with the Superior Court more than three times indicating and filing for continuance of mediation, submitted countless documents to Bank of America, all to no avail.
They had failed to act with due diligence and I receive letters and requests from so many different contacts at Bank of America that it is clear that there is a complete and total lack of communication in regards to my modification. I have submitted a letter of hardship and all financial documents. I receive disability payments and have rented out two rooms in my home which together meet the requirements for a modification, but I am told completely different things by different contacts at Bank of America.

After a couple of attempts to modify my mortgage payment with B of A, (Countrywide back when I bought the house), I lost my house in Texas this past December. It was always excuses and missing documents. I did send in all documents required at all times. I'm very angry, upset, depressed and frustrated to see that there was nothing else to be done. I have no money to pay for a lawyer either. I know that I'm not alone out there. Many people, a big number, are going through the same situation as I did.
I do hope that people get together to fix this mess with this bank institution. I, myself, am writing to the President. I'm writing a very detailed letter of my situation and my feelings towards this injustice practice from the institution. I'm constantly looking out to see if there is any class action law suit against B of A in the state of Texas. If I lost my house, we can still help other people save theirs! If you have the time, please write to the President of the US too! The more letters, the more we will put our voices out there!

I'm a first time homebuyer, but when the market dropped so did the value of my home. I was planning to refinance so I decided to go with the bank who I had my original loan with, which was BofA. After numerous hours spent on the phone with the loan officer, my loan was denied without explanation. After two months of going through the process, the day we were supposed to sign, the auditor tells us it was canceled. I was waiting for two hours waiting with no notice from BofA. My time is precious and to not call your customers back is ridiculous to me. Every single time I called I got a machine. I didn't get a call back until the next day! Turns out you can't have PMI and HARP assistance. The underwriters didn't notice. Complete waste of time. I like USAA a lot better.

We are in the same situation as everyone else who tried to get a loan modification within the last two years. Where is the justice? Can't we all band together to do something? We were put on a modification payment for over two years. After making the payments, they said that amount we were paying would never have gotten us on a modification. We kept the original FedEx paper with that amount on it from them. We are now $200,000 under water on our house. Is it worth it? It actually has taken a toll on my health. We are looking at losing our home now. I feel like they set us up to fail. They knew the payment was pulled out of the air so they were just collecting the payments with full knowledge they were never going to modify. Because my husband returned to active duty, our mortgages were modified to reflect the max interest allowed to be charged to active duty service members under the SCRA. Since that time, every couple of months we get 3 FedEx packets and numerous collector calls about not paying our mortgage. Every payment has been on time for the correct amount since the inception of each loan. We have called and explained and get the run around each time. We have been told that the SCRA department pays a portion of the payment (the difference in our new payment and the old payment) and that sometimes that department doesn't "put through" their part, thereby generating these harassing calls and overnighted packages. It took almost 3 months to complete the modification during which time we continued to pay the correct amount. We still continue to pay each loan on time every month.

I have a mortgage with Bank of America. October this year they stopped sending me mortgage statements. I didn’t realize at first as I’m prompt about payment. So I continued to pay monthly at my usual amount not realizing that statements had totally stopped as opposed to just being a missed month. In December they increased my mortgage due by $64 but never notified me. December 7 they received my electronic payment of $3,240 for December. They say because this was $64 short they did not credit any of that to my mortgage owed. Instead they sat on it. I receive no notification of the deficiency. I have a printout of the website from January 8 proving there were no alerts to my account from the previous 60 days. So I had no knowledge of the deficiency and that I needed to send them an extra $64, which would have been no problem for me. Instead, they put my house in default. January 8, they received another electronic payment from me for $3,240 (scheduled days ahead) as I still didn't know anything was wrong. January 6 (a Saturday), I went on their website for another reason and saw suddenly my house was in default and they claimed I owed them 2 month’s mortgage (the grace period goes to Jan. 16).
At this point (well as of January 8 which was a Monday) they had $6,480 of my money in their possession. My bank from which payment made had been made (Wells Fargo) had not received return of any of my funds and I had received nothing in the mail. January 8 I called the bank. After a long discussion it was agreed that if I just paid the $128 shortfall (which was the $64 shortfall from December and January) that all would be resolved. I did this that night, scheduled an electronic payment. But it takes 2 days for funds to transfer so Bank of America got that money Jan. 11 (they say). During the Jan. 8 call I was told that my December payment had been sent back to me on January 3. I only got it last week, and the post mark on envelope says Jan. 10. Part of the resolution was that they were to have put stop payment on it as of the Jan. 8th date, so that money was still in their possession and as a result they had a full $6,480 of my money in their possession.
Now they are saying because I was overdue on my December payment by 30 days they put a notice on my credit report that I was delinquent in December. When in fact at that they had all my money in their possession and simply by crediting December for the full amount there would have been full payment before the end of the December 16 end of grace period. The ramification is that my credit, once spotless, is now damaged and so I can't refinance. I believe this was a scam to prevent them from losing my mortgage to a refinance. In short, between December 7 and January 8 they were in possession of $6,480 of my money that they did not credit to my account, and so they put my house in default as a result and reported me as delinquent on my credit report and now I can't refinance. While they assert they sent $3,240 back on Jan. 3, I only got a check the week of Jan. 16; the check is dated Jan. 4, the cover note is dated Jan. 5 and the post mark on the envelope is dated Jan. 10, and so it was impossible for me to remedy any of this as they had my money and provided me no notice that there was a problem. In fact on January 8 when they were asserting they had sent me my December money back; it was still in their possession as it didn't go from the post office until 2 days later. Now they say they can't fix the credit report issue, which is all I want as I did nothing wrong.

First off, we want to say that we did not choose Bank of America, our company, Countrywide was bought by them. Secondly, this is not the first problem we have had with BoA. We have had numerous problems with the bank, some of which seem to be outright fraudulent. The most recent (January 2012) prompted this complaint: The bank "accidentally" took a double mortgage payment out of our checking account (another separate banking institution) without our authorization. It took them seconds to do it, but it has literally caused us major financial havoc and lost work to resolve it. To date, it is still unsolved. Not only did the double payment result in our account becoming overdrawn, but it also resulted in all of our other bills bouncing as they tried to post to our account.
The bank that holds our checking account has a $25.00 fee for everyday that the account is overdrawn. Also, a $25.00 overdraft/returned check fee for each item that posts. As you can imagine, this has caused my family to not only have zero funds for bill payment, gas and groceries, but it has also created a nightmare in paperwork. The bank insists that we must prove the proof that the transaction occurred, which seemed odd because the very second in time that the transaction occurred was noted on the BoA online banking page that I log into to monitor my mortgage. I've learned the hard way with BoA to do this almost daily. Originally, BoA admitted the error and said it would be fixed within 48 hours. It has been over two weeks and racked up over $250.00 in fees that we have so far identified (not counting the late charges of all of our utility/phone companies are going to bill us because we are now late on all of our payments).
In addition, both myself and my wife have spent countless hours on the phone and faxing documents to resolve this matter, missing in total another two days of work and a loss of further income. My wife does not get paid days off from work and I work on a commission. Because this is not the first error nor even the second error that BoA has made resulting in financial hardship for my family, but in fact is the third time, I am seeking some kind of remediation. The bank seems so powerful and we are a working class family that pays our bills on time! How could this happen to us and we still feel so powerless? I am writing to state my unhappiness with Bank of America. I am one of those Americans struggling to stay afloat. I currently pay a very high interest on my 1st and 2nd mortgages, and have contacted Bank of America for some assistance. I do not have the cash to refinance, nor do I qualify for the making home affordable program. So, I asked about modifying my existing loan, to try and get a lower interest rate, and the response I get is, "due to the fact that you are current on your mortgages, you do not show hardship".
Frankly, I think this is a bunch of **. To think that one must be delinquent to even be considered for a loan modification, is unfair. I've mentioned to Bank of America that I can provide proof, showing the money coming in, is less than what's going out, but they still refuse to help. Maybe I should have thought twice about purchasing a home a few years back, but isn't it every American's dream to own one? I just hope other people get treated better than I was.

We have applied for the Making Homes Affordable Loan in Sept. 2011. My husband is disabled, and our income has decreased tremendously! We have sent paperwork in over and over again, mind you, the same paperwork. We were told by Bank of America, that we should just stop paying our mortgage, maybe we would get help then! I was also asked to send a letter from his doctor stating he was unable to work? Now if he is receiving Federal Disability, isn't that proof enough?
They keep telling us that our information is in underwriting, but every time we call about letters they send us needing more paperwork, our account manager tells us to ignore them, they have everything. I still faxed them what they needed, but I received a letter saying we were denied, because the paperwork wasn't sent in time! Yet my account manager, and his supervisor tell us to Ignore it, it is still in underwriting!? We are now putting an appeal in. It is sad to say that I believe BOA is just giving us the runaround, so they can say they are doing the program the government requires them!

In February 2007, I entered into a mortgage with LaSalle Bank. I started having difficulty making my payments and asked for a loan modification. This is due to the bank not informing me of all the additional costs. I requested that all the property taxes be included in my mortgage payment, which they said it was. It turned out that it was not true, and my house which started out at $1600 ballooned to $2,300.00. They did not include all the city and township taxes.
LaSalle Bank refused to work with me. They proceeded with foreclosure in May 2008. During this time, my loan was sold to Bank of America. I contacted BofA, and they stated they will provided me modification and provided the amount of, I believe, $1,400.00 per month. Two weeks later, someone was taking pictures of my home and said it was being foreclosed.
I contacted BofA, and they stated the foreclosure was still in effect and said the modification was in error. The house was foreclosed in October 2008. I beg for another month to get my items out the house, and they gave me until November 2008 with $1,000.00 in moving expenses. In January 2009, my home was sold while my name was still on the mortgage deed.

I started modification on 2009. Same story as others like lost paperwork but Bank of America never says they lost it, only that they don't have it, more applications and change of person handling it. Oh, we were approved and started making the trial payment over three years now, and still, yes you know it's coming, we were sent yet another new application asking for the same old stuff this last Saturday and yes, again today, Monday. They have said no, then yes, then in-house, then MHA, always the HUDD number. No lawyers will touch it. Where is the justice?

I am writing you this letter in hopes that our story might interest you concerning how the banks (Wells Fargo and Bank of America) are handling foreclosure on properties with equity.
So we made the decision to save our home and applied for a reverse mortgage. Our reverse mortgage was a go until Wells Fargo realized we had a few dollars in the bank. It went from needing $4000.00 to close a reverse mortgage to $13,000.00 to close the loan (we had the funds). We had 3 appraisals done on our property that all listed our square footage at 5700 plus square feet and the value at $475,000.00. However, the day of funding, we were told our home value was no longer $475,000.00 but now the value was $400,000.00. To our surprise, the previous appraiser had made corrections to her report. We disputed the correction because it reduced the square footage. I called the appraiser and she told me the lender didn't want to do our loan. So they sent her a total of 13 emails asking for various changes to be made.
I called Wells Fargo and BOA and advised them we felt like there was an error with our appraisal. Laura ** from Wells Fargo refused to consider that possibly there was an error with the report. We filed a complaint with the Arkansas State Appraisal board. After reviewing our complaint and reading the response of the appraiser, the board decided to place the appraiser on probation because she failed to follow State guidelines for appraisals. Even after discovering a mistake has been made, BOA has informed us the investor will not do an interest rate change, a maturity date change or an increase or decrease to the balance.
Bank of America/Countrywide has taken our money and randomly applied funds however they feel with having to be accountable. I have sent in 3 qualified written request and received acknowledgment that our request has been made. However, BOA has refused to provide us the information on who owns our loan (since Mers filed all the documents) and complete written accounting on all charge and how each lump payment was applied.
We originally purchased our home in March of 2005. Our mortgage was with Fremont Financial which we would three months later start paying Countrywide. In April of 2007, our Sub Prime loan adjusted and monthly payment increased about $1500.00. We were about 4 months delinquent when we made a payment of $115,247.00 in August of 2007 (we were told this payment was applied to the principal balance leaving the balance of $281,941.72). Then in January 2008, we paid another $10,000.00. This is where the nightmare begins. Our loan remained delinquent with all the monies paid.
Fast forward to June 2008 and we were told our loan is delinquent and our home is in process of foreclosure (with Countrywide). We agreed to a repayment plan for 18 months (which could be paid off at any time). This repayment plan included a payment of $7500.00 to start and monthly payments of $3847.60. We made the payments until March 28, 2009 at which time we called in and requested the amount needed to payoff the repayment plan and resume our regular payment. We were advised we would need $13,348.00. We sent in certified funds with a letter asking for the payment to be applied to the repayment plan and resume our regular payments (to Bank of America).
We sent in our first regular payment in April 2009, which was returned to us with a letter stating we had failed to keep the repayment arrangement. We made numerous phone calls to Bank of America between April 2009 and February 2010, on each call where only one person could remove the codes to assist us (Ruby **) and she was never available nor was there any other person who could assist us. Messages were forwarded to the supervisor who never phoned us back. We attempted to us NACA, but were advised the investor did not participate in the making homes affordable program. Our property does not have a deficient balance. However, the bank has kept our account delinquent in an attempt to foreclose. There is no accountability once the bank says you are delinquent. They are the fox guarding the hen house.

I was working with BOA for more than two years. They didn’t help with my modification. Then I paid a broker to help out with the modification couldn’t do it to. Then we went to foreclosure and force to short sale the property but we find out BOA is only servicing our loan and the investor don't want to deal with us the preferer to take the house away from. BOA is a very dishonest institution and not willing to help customers.

As reading all of the other complaints, I fall exactly into the same complaint list as the other Bank of America Mortgage clients. Being an election year, and Bank of America being the most corrupt mortgage company out there with millions of clients who were thrashed into their pocket by Country Wide (which I feel was superior to what we all are going through now), maybe something could be done. Look back into the history of these people and how they started as Bank of Italy in California and made their money in the motion picture business.
Hello clients, they do not care if they foreclose on your property, look at the hidden costs they put onto your account when you ask for help, and yes I say hidden to the corporate law world. Seems they would not want millions of foreclosures on their pro forma, but there is something going on with that, maybe some sort of tax relief for them. Help Bank of America, we have tried to show empathy. There is no heart there, just a total empire of lies and corruptness. Are they in politics?

After several failed attempts to modify my home with BOA, I was given an in-house modification, to help me with back payments, and a better payment. I was wrong! My payments have only increased, and it became harder to maintain. My home was in probate for 5 years with Countrywide/BOA, and finalized in 2011. The modification was needed to bring the account current, so we could assume the loan. Mind you, an AB loan with BOA wasn't assumable. Now, the loan was eligible for the Obama Modification, but I wasn't contacted, until May of 2011, and now I can not modify the loan again, to many modifications, I am told.
I have requested a simple interest rate reduction of the loan. They said it can't be done. We are currently at an 8.2% interest rate. I can't ref, because that's just more money added to the overall loan amount. I was forced to take this high interest rate modification, to save my home from being sold by probate, and the people at BOA knew what they were doing, locking me into a high interest rate loan. The modification took me 2 years to complete, and with no help from the bank, but hard work on my part, and endless calls to every department possible.
What we needed was the guidelines of the Obama plan, to help lower payments, not to increase them by hundreds of dollars a month. The difficulties with dealing with BOA is relentless. No one has the same answers, and no one can really help. I have been in contact with the CEO office. The first time, they were very helpful. Now, they just want to add more money on the loan, and not reduced the interest rate. Please tell me how this is helpful? They are holding me to my wallet. They tell me I might have to sell my property, if I can't afford it.
That's the latest helpful assistance from BOA. Their modification packages and guidelines are not clearly outlined to the customers, and you could be working with two or three departments on different modifications at the same time, which did happen to me. The process is confusing, and now we are stuck with a loan modification, that is no help. How are homeowners to get help, if the bank is not holding up to their end of the bargain, and what about the millions they were given to assist us? Someone need to hold BOA responsible to the homeowners they promised to help.

We live in Carver, Massachusetts and we are having a major problem with Bank of America. We originally started the Making Homes Affordable process the end of November of 2010. It still has not gone through and there is a constant threat of foreclosure. They keep "losing" documents, say they never received them or the faxed document from another department did not come out clear, being given misinformation by each representative I talked to. By them doing this, I keep missing deadlines. Our mortgage was originally held by Countrywide and was bought by Bank of America. Please find below the documents I have received and/or conversation I have had with different Bank of America representatives. This whole process has been a nightmare and we are begging for assistance before they foreclose on our home.
On March 4, 2011, I received a letter requesting more of the same documents by March 18, 2011 (sent them). Due to the lack of ability on BOR, the following phone call is when I started to document all conversations and with whom. I also made copies of all documents sent to them. I didn't do that before because I did not think that they would be like this.
On March 28, 2011, I received a letter stating I was not eligible for the Making Homes Affordable program due to lack of requested documents that were already sent on multiple occasions. The letter said to call before April 24, 2011 to file an appeal. I made the call once I received the letter. I talked to a representative (Marie ID# xxxx). The woman looked at my documents sent in that were denied and she couldn't find anything wrong with the RMA but did say on one of them I crossed out a number because I started to write the wrong date then wrote the correct one.
The woman said that she filed the appeal and to resend the documentation needed due to my financial data being outdated. She also said she sent an email to Sonya, the person working on the case updating her on the call and requesting that she call me back. She said that I should hear from her within 72 hours. I faxed the packet to two different fax numbers that I have been given, and sent it in two separate FedEx envelopes just to ensure someone got something!
On March 30, 2011, (letter dated) I received a letter thanking me for sending in the financial documents to support the Home Affordable Modification program loan review. It stated that once they completed the review and would contact us to discuss our loans eligibility for a modification with one of three responses: approval for the trial period, not eligible but with other options for a different modification program or the need for more information.
On April 19, 2011, letter dated stating our house was going into foreclosure and to call regarding a short sale by the 28th. I called and talked to a woman (Elaine. ID# xxxx) who said no appeal was done and due to the paperwork being dated 3/28/11 not 3/18/11 it was denied. She looked at the notes from my call on March 28, 2011 and it notes that we went over the documents and stated that the owner upset, needing more documentation, no error on the RMA and FedEx ASAP. She also said that the woman should have told me to call back to ensure all of the documents were received even though we got a letter stating that they did receive them. She also said something about it being the 4506-T that was the issue but did not expand anymore about it.
I then talked to the supervisor (Alex ID#xxxx) and he said that due to my documents being dated the 3/28/11 and they were due no later than 3/18/11. My loan would not have been eligible to file an appeal in the first place. I told him that the documents were dated the 28th due to the conversation with BOA on 3/28/11 because the ones sent before the 3 /18/11 deadline were "missing" or not received. I told him that I got a letter from BOR dated 3/30/11 saying they received my documents and it would be under review and that I would receive a letter with one of three outcomes (more information needed, loan mod was successful or it was denied). He said that the letter was automated generated and did not mean anything.
I then asked if I could still file an appeal since I was still in the time frame (before 4/30/11). He said unfortunately it wouldn't be eligible because of the documents being dated 3/28/11 not 3/18/11 and the only thing he could do was to request to re-apply (we updated our financials and started the re-application process) and I would hear something in 10-14 days. I told him that it would be past the short sale deadline and he said that "unfortunately due to the documents dated the 28th not the 18th of March this was all he could do.
On May 12, 2011, I called and talked with (Danielle ID#xxxx). She looked back at the notes about the last call on 4/19/2011. She said the account still had in foreclosure status on the account but with no sale date, also that it was in review for the loan modification status. On May 17, 2011, I received a call from Skip from the traditional Home Loan Modification department. He did not have any information about the Making Homes affordable process and that they were a different division. He gave me all of the information needed to start this process: pay stubs for a 30 day period, most recent bank statements for 90 days, detailed list of household expenses and a letter with specific detailed of hardship explaining the reason. I told him that since I was still in review for the Making Homes Affordable process. I would like to wait until that was finalized since it was so chaotic and did not want to start something else until the first was finished.
On May 18, 2011, letter dated that states they reviewed our request for participation in the federal governments Home Affordable Foreclosure Alternatives (HAFA) short sale program. Then it gave other alternatives for a standard short sale. On May 24, 2011, I received a letter dated May 17, 2011 stating they have received our request for workout assistance. However, they were unable to complete their review process due to missing information. They had attempted to contact us to obtain the missing information without success. Consequently, if they did not receive the information previously requested, our workout file would be closed on May 31, 2011.
On May 24, 2011, I called as the above letter requested and spoke to Jodie ID # xxxx. She said that it was a different department than the Making Homes Affordable line. All the information she had was that there was missing documents but did not have access to what was missing. She said to call the Making Homes Affordable line for more information. On May 24, 2011, I called and spoke to Mario ID# xxxx. He looked at the account and said that there is no sale date and there were two reviews processes at the moment.
He found the first denial due to the documents dated March 28th and not the 18th. Also that 4/19/11 then proceeded with the re-application process and it was put through for review on 4/20/11 and that it was denied because of missing documents. A note was put in that a new packet was sent out on May 19, 2011 and proceeded to look deeper into it. This is when we got disconnected. I tried to call back to talk to him again since it was a very long conversation but I was told that they were not able to connect to him again and the account was locked because the previous operator was still on the account notating the account. I was told to call back.
On May 24, 2011, I called back and talked to Darlene ID# xxx. She said that they do not call back when disconnected. She went through the account and said that our tax returns were submitted on 4/3/2011, that a letter was sent out on the 19th, but did not expand on the letter. Also about the re-application process on 4/19/11 and it went through on 4/20/11, a new application package was sent out at that time (did not receive). The account was also sent to the mod team for consideration and Making Homes Affordable was still considering us. She said it may take 30-40 days to receive the application package and put in another request to send one out. She said to call back around the 2nd week in June if we don't receive it and to remember it takes time for these things to process and due to the reason of the denial, we were able to re-apply because of the reason stated.
On June 14, 2011, I called to find out if another package was sent since we still hadn't received one. I talked with Katty ID# xxxx. She said that the work out was cancelled on June 1, 2011 because they never received the documents requested. I told her I never received any request/another application package. She looked through then notes and said she saw a note that a package was sent out on 5/24/2011. She then said she put in another request to send another one since I did not receive that one and to try again in 30-45 days.
On July 11, 2011, letter dated stating that they reviewed our appeal of their decision that the loan is not eligible for the federal Home Affordable Modification program. "Unfortunately, this letter is to inform you that your loan is still not eligible for the program."
I know that I placed another call after this letter, but I cannot find the information. I do know that I requested another application package request be put in since I never received the ones I had been requesting since April 2011. At this time, I was dealing with personal issues with my daughter and medical issues (cancer scare) of my own. I honestly did not have the energy to deal with Bank of America's nonsense any longer. I was ready to give up. It really was not worth being told multiple things, and being given the runaround like they had been doing to us. I had the I don't care anymore, just let them take the house attitude. It wasn't until after the storm and seeing a tree about to land on the house and the possibility that we would lose the house did I start to have a different attitude about our home.
That is when we started to look up BOR issues on the internet and found that this is not an isolated incident. We also started to talk to other people about BOR and we have two friends going through the same problems with them. There are also multiple people who are friends of friends with the same issues. These things and receiving the letter from the lawyer for BOA made us decide to try to fight for our house again. Again, here is a list of items received and/or BOA representatives we have talked to.
On September 16, 2011, letter dated from Harmon Law Offices stating they were retained by Bank of America to foreclose on our mortgage and we were to respond within 30 days with the amount necessary to reinstate or pay off the loan changes daily.
On September 22, 2011, letter dated from Harmon Law Offices stating they were working with BOA to help keep our home. The letter had alternatives including forbearance plan, reinstatement of loan, repayment plan, and modifications, deed in lieu of foreclosure, short payoff, assumption of loan, to fill out and return the Freddie Mac borrower financial statement.
On October 4, 2011, I faxed the lawyer the documents I faxed to Bank of America at the same time-- two separate divisions and his requested documents. 31 pages faxed to his office included: Freddie Mac Borrower Financial Statement, copy of the packet that was faxed to BOA for a request for a Loan Modification with the cover sheet explaining the documents, a copy of the packet that was faxed to BOA for another attempt at the Making Homes Affordable Program/ Request for Modification and Affidavit (RMA), with the fax cover sheet explain the documents. The application packet was found on the State of Massachusetts website with information for the request.
On October 12, 2011, letter dated stating that they recently received our request regarding workout assistance, which our request had been forwarded to a specialist in the appropriate department for further research. They appreciate our patience while information is gathered in order to respond to the request. They would contact us by telephone or in writing when their review was completed.
On October 26, 2011, letter dated stating that according to their records a notice of intention to foreclose was sent to us on 10/18/2010 indicating our loan was currently in default. The letter was to supply us with addition information to the previously mailed notice. They said to call because they wanted to help us determine the best option for our individual situation to avoid foreclosure.
On November 15, 2011, I called BOR as requested in the above letter and spoke to Joanna ID#xxxx. She said that the house was in foreclosure but the date had not been set yet and they received the documents on October 4, 2011. I asked to update our financials, told her that they have not changed and to look at the documents I have sent, she did and went over them with me. She said something that my debt to loan ratio was not make us qualify. When I asked her that isn't that the reason behind the modification and she really didn't answer.
She then said that they will put me through for a new traditional home loan modification and it can take up to 3 months to go through. She also said that they have changed their policy on how to do the modifications and they will now only have one person, a case relationship manager in charge of our case-- only one point of contact. She said it will be about 72 hours for a case relationship manager to call me and she will ensure she would expedite this case. It told her that it was good to hear that only one person would be in contact since for over a year I was being to conflicting information.
Even after being told that only one person, a case relationship manager would call and be the only contact, we received letters from BOR that they had local customer assistance centers in our area to have a personalized discussion with a home loan specialist. These letters were dated: November 16, 2011, November 21, 2011, and December 14, 2011.
On December 8, 2011, letter from the lawyer for BOR stating that enclosed is a copy of an Order of Notice in connection with the above reference matter. There was an Order of Notice from the department of the trial court/ land court that BOA filed with the court a complaint for determination of defendants / Defendants Service members status. The letter was from the Deputy Sheriff. It also said if you now are, or recently have been, in the active military service of the USA, then you may be entitled to the benefits of the Service Members Civil Relief Act. If you object to a foreclosure of the above-mentioned property on that basis, then you or your attorney must file a written appearance and answer in the court at Three Pemberton Square, Boston, MA On or before January 23, 2012.
As of this writing, we still have not heard from out appointed case relationship manager assigned by Bank of America and I have not called Bank of America due to the entire above runaround answers/directions. This entire process has been time consuming and overwhelming. Any assistance and/or direction you could provide us will be greatly appreciated. Please feel free to contact me. We applied for a loan modification to lower our payments. I lost my job in December 2009 and my daughter is now supporting our home on a housekeeper's salary. Instead of lowering the payment to "Make Homes Affordable" as they (BAC-B of A) say in writing that they will do, they raised the payment (now $561.81, use to be $550.00) and I was told to take it or leave it. A loan calculator said my payment may get as low as $341.00. They only lowered my interest rate by 1.25%, from 7.75% to 6.50%.
They went by our financial situation back in the Summer of 2011, however we work for the hospitality industry and those 3 months are great, the other 9 months we struggle so hard we have to use payday advance loans to get by. They also added into our income $447 a month for food stamps! We use to get $360 a month, now we only get $195 a month for a family of 3. I sent a food stamp history, they did nothing.
The modification got approved in November 2011 and I sent copies of our declining paystubs every two weeks like clockwork. They disregarded the current low paystubs (from 8/2011 to 11/2011) so they could make our payments high and unattainable! A win-win for them, a lose-lose for us. Then they told me there was no one in the entire company between my account manager and the underwriters that could answer any of my questions or help me.
They called me continuously until I finally signed the papers. I explained to anyone who would listen over and over again that they had our financials wrong. But it didn't matter to them. I felt I didn't have a choice. After I signed them, the BAC (Bank of America/Country Wide) "HOPE" department called me and said I should have been offered a negotiator, but now it was too late. I called my "account manager" today 11/28/11, and he told me the underwriters were the negotiators but they don't talk to clients.
So who was supposed to talk for me? The case manager who told me to "take it or leave it"? There has got to be something we can do. And guess who underwrote the loans! Fannie Mae and Freddie Mac! After that, I found Florida's Hardest Hit Program, but they can't help me for 6 months because of the "so-called" loan modification. I bought this place in February 1999 for $60,300 and they say I still owe $53,000+. After 13 years only $142 goes to my principal and after 13 years they still won't let me drop the PMI which is $25 a month!

Our mortgage was sold to BoA, and the effective date of new servicing was October 20, 2011. That day came and long passed before they actually processed the transfer and acknowledged our account. We were assured by every agent that we wouldn't be charged late fees and we would not be reported late. We were also advised by the old servicer, BoA, and HUD that if BoA didn't notify us of the transfer in a timely manner (2 weeks, I believe), they were breaking the law and would be penalized.
We paid the old servicer as advised, and when they forwarded the payment to BoA, BoA sent it back to our bank. After daily phone calls to both the old servicer and BoA, we finally got a random SSRA letter that happened to have an account number on it dated December 15, 2011. We promptly called and made 3 months of payments. We did not get the transfer notification until this week, late-January 2012. If you're keeping track, that is 4 months late.
We were charged a late fee, we were threatened on our first statement with consequences of delinquency. Every agent we've spoken since getting our account info has absolutely no record of us calling. This makes me wonder how they can track people calling to threaten them, but they can't track people that call in whom they are threatening. BoA is run by criminals with no regard for the folks that pad their pockets. I will follow up with HUD and I will be working with an attorney to ensure that a legal consequence to BoA is filed. This is criminal.

Yesterday I called Bank of America about my existing credit card which I have had since 1993. By the way, everything that I have ever charged on the card was paid on time and double payments. The customer service rep told me that they were going to issue me a new card because of a charge which I did not accrue. It turns out they lied. They cancelled my card because of some discrepancies on my credit report. I told her that this had nothing to do with my business with them. She refused to work with me and cancelled my card anyway. This is not the way to do business with a long time customer. So, what I am planning on doing is taking my savings out and put it in a small bank where you are treated like a human being.

After going through a year and a half battle with Bank of America to have my ex-husband removed from the mortgage, I was mentally drained. They "lost" the first set of documents I mailed them and thankfully I made copies of everything to send to them again. They could not tell me what happened to the first set of documents.
For the past 7 years, I have been making the mortgage payment via Bank of America pay plan so they can pull the amount from my checking account (a $4.00 fee for each payment is also charged). Despite all this, I still had to "qualify" to assume the loan although I was primary on the account and used my VA eligibility. September 2011 it was finally approved. In December 2011, I received a check issued from Bank of America for half of what my mortgage payment is with a note stating they have not received the full amount for my mortgage payment. Upon calling I was told that there was a glitch in the system. Again on the 17th of January 2012, I receive another check for the same reason.
Upon calling Bank of America, they could not tell me why this was happening and said the only thing they could do was to cancel and restart the pay plan. I was charged a late fee in both instances and that was finally waived. I'm still out the $8.00 for the "pay plan fee" and have to dispute them for that. Ridiculous! They said if I had a checking account with them, it would be easier to get the mortgage payment, etc. I made it clear to them that the only reason my mortgage was with them is due to it being sold by the previous mortgage company. I am in the process of refinancing with USAA at a better rate and a true knowledge of customer service. I will be glad to be rid of Bank of America once and for all.

In November 2010, we were contacted by Bank of America and were told that they had not received our last two property tax payments, which we pay every quarter. They claimed that they paid in our place and were expecting us to send them checks to pay them back for covering us for these last two quarters. This was completely false. We contacted our bank, who printed out the July and October property tax checks and even provided the exact date and time that Bank of America cashed the checks.
For the next few months, we spoke to numerous B of A representatives, whether we were calling to correct the matter or they were calling us to harass us for payments we already made. Bank of America claimed that even though they cashed the checks, they could not find it in their system and that we still owe the amount of two quarter payments.
We were still trying to correct this previous error when we were told that, once again, our next property tax payment never made it to them. Once again, our bank provided us with a copy of the cashed check and evidence that Bank of America cashed it soon after receiving it. We have spoken to every representative and supervisor at Bank of America, we have gone to our local Bank of America branch several times, we have called 311 for help, and we have spoken to agents at the City of New York Department of Finance. All we get is the runaround and a mass of people saying they will help us resolve this matter, when it has gone nowhere for over a year. These 3 checks seem to have disappeared into thin air and yet the money is not in my bank account and we still owe B of A for 3 checks they have already cashed.
Bank of America is a ludicrous and corrupt organization; we have been receiving 10-15 calls a day from debt collectors about this matter. This is an abusive corporation that must be stopped. If anyone is aware of any attorneys who may help, or if anyone is interested, I am looking to contact an attorney who can help people dealing with Bank of America troubles. This is the worst bank I have ever dealt with. I have a couple trying to assume my mortgage. I purchased another house. It amazes me how after 2 months they still don't have an answer as to whether or not they qualify. We have been told that they’re busy, they’re short handed, they've had holidays, they’re at least 3 weeks behind, etc. When you call the operator will tell you they have 72 hours to call you. They won't transfer your call and tell you who's handling the loan. They will tell you at what stage the loan process is in or anything. I would not recommend this bank to anyone for a mortgage. They have lost our paperwork and said it was probably shredded. We have confirmation it was delivered.
It took over a month to get confirmation package delivered in mail. We finally got it faxed through to them on the 21st. I was on the phone when I was told they just received the fax. Then a couple weeks later they said the fax wasn't received until the 23rd. All they’re doing is delaying this process and wasting me time and money. This is no way to treat a customer and I would call and tell them this but they don’t return voicemails either. The consequence is possibly losing a buyer for the house that's been vacant for a year.

We have been trying to work out a modification with Bank of America for over a year, but have only been told one lie after another. We have sent every document requested and still nothing. We get the run around for months and suddenly there is no record of the modification and the same type of documents are again requested.
Now while we are waiting for an answer their attorneys have started the foreclosure process. We can make our payments, but they will not accept them. We were sending two payments a month when this started. The last two were returned and foreclosure started.
One would think they would rather have the mortgage payments rather than deal with the foreclosure. They have people occupying the house with the ability to pay, but obviously they don't care. We don't know what else to do.

Bank of America loan modification is a joke. We have been in this process since Sept. 2011. We have been sending them payments and they don't seem to see this as trying. They keep giving us a runaround on our loan process. We sent in our paperwork over the weekend of Thanksgiving. Our paperwork stated to be mailed back by Nov. 27, 2011 that was on a Sunday. No one is open on a Sunday. I have been calling to get the situation resolved but no one seems to know what is going on with our loan modification. All I get is a runaround on the phone.
The loan modification to me is nothing but a scam and to get more money out of people. They aren't even trying to work with people to save their homes. I know that I am not the only ones they are doing to this to! I don't see how they can get away with everything that they doing. Their customer service isn't friendly and could careless about you as a person or your home. All they want is our money!

I believe my husband and I have fallen prey to the Countrywide/Bank of America mortgage mess. We do not have any documents from them. They also had us obtain a sub-prime equity line of credit against the home and we do not know exactly what we need to do. In NJ who do we contact?

I lost my job in April 2011. I was able to obtain full time employment four weeks later but with a significant decrease in salary. I went from $4,400 month to $2,300 month. Though never late, in default or over 30 days paying my mortgage, I reached out to BOA for a modification due to my financial hardship. I have been denied across the board, mortgage not before January 2009. I have spoken with over 18 individuals never the same person, always the same response, "We have no modification for you."
They will not even work with me on any request I have bestowed. They have continued to deny me. They have also been instructed not to communicate with me via email and it has been two weeks since I contacted BOA again and they have yet to contact me. I don't care if my mortgage is not before January 2009. Not everyone is. More people have lost jobs since January 2009 and I am one of them. I was fortunate to find full time employment but I am not making the money I used to and therefore I do have a financial hardship.
I started this in September of 2011 and BOA will not work with me. Aside from hearing from various people, they do not know what another is speaking about. One person says one thing and someone else says another. How can you work for the President's office in the mortgage department and be unfamiliar with the programs the bank offers? It is absolutely ridiculous the lack of customer service, the lack of knowledge, the lack of commitment to homeowners to help assist, the ignorance of these supposedly highly qualified advocates.
I am tired of being contacted by different people. I am tired of not being contacted when requested. I am tired of them not being consistent except for the fact my mortgage is not before January 2009 which I knew from day one. I reached out for help and get denied. I was told, "You have to be at least 60 days late to be considered even that is not a guarantee," and at the beginning I was told to let my house foreclose!
Nice advice from a bank who is supposed to work with homeowners to avoid foreclosure at all costs and these people still have a job. Before my job was eliminated, I had no financial hardship and paid my bills with no problem. Now, I have a problem and I am not going to purposely not pay so BOA can continue to screw with me as they have with so many others who have foreclosed and been kicked out of their home. That should not happen and being told there is not a modification for everyone is absurd. There is always a way to work something and this back and forth is beyond and something must be done about it. I was told, "We have programs for people like you who have not been late and pay within 30 days," then "No, we have nothing. You have to have paid for 12 months." I have done that. Make up your mind. Which is it? BOA is completely conflicting.

To all having problems with Bank of America, you need to have a securitization audit done on your loan. That will not allow BOA to collect any insurance money on your loan or home. Therefore BOA will tend to work with you a little better. I did the HEMP program also and was dragged along for a year and then finally after trying to contact them throughout the year, I finally got a letter from them saying I was denied. I found a company that was willing to help me and they are the ones that did the securitization audit. They are TILA solutions. They have been a great comfort in this mad situation. I am now going to court with BOA over fraudulent acts that BOA has done with my loan.
I have been notified that my house is up for foreclosure and has been up for sheriff's sale 4 times since 2007. They put my house up for sheriff's sale while I was making the modification trial payments. I was making trial payments (did the three months) and never heard anything from them, so I continued to make the payment every month. Then, one month after 8 months, they denied my payment. I tried to contact them but was never able to talk to any one so the next month, I tried to make payment again and they denied it. A week later, I got the foreclosure letter and sheriff sale letter. I don't have one nice thing to say about Bank of America. Over the past 3 years, it has been nothing short of a nightmare with them. They do not call you back when you have a problem, nor do they correct their problems. Reps. have promised me they would correct many mistakes they have made on my home mortgage loan/statements. They have not. I made regular payments on my loans and they choose to ignore it and send me statements that say I haven't made a payment or credit my loan account.
When asked about a loan modification, I got no answers. I had appointments set with Bank of America. The rep. did not call me back, did not keep the appointment. I had my credit score falsely decreased greatly by Bank of America. They reported I wasn't making payments when in fact I was. They illegally attempted to foreclose on my home because of this. I had to pay thousands of dollars to save my home. They still will not straighten out the problem. I know of so many others who are having very bad problems with Bank of America.

Our short sale experience with Bank of America was horrific. Without including all the details, it took over 9 months and nearly $15,000. Perhaps the biggest issue is that we felt taken advantage of. For example, after several iterations, we were finally at the closing table when we noticed Bank of America was not going to release our debt liability. That's the whole intent of a short sale! We contacted a lawyer and were able to get the release - after Bank of America, for the 3rd time, increased our closing costs. We have contacted numerous other people who did a short sale with another bank in considerably less time and money. 9 months and nearly $15,000 to complete a short sale.

BofA refused to make a scheduled monthly payment to my 84-year-old mother under the terms of her reverse mortgage. They lost her annual confirmation of occupancy, and when it was faxed to them, indicated that they would not go back and make the current month's payment and that she would have to wait for the next month.
After raising this several levels to complain, the bottom line is that the bank doesn't care or want to be bothered. They could easily send a one-time unscheduled payment to help with cash flow, but they are just unwilling. Worst customer service ever. I am going to change depositary banks as a result. I would like to see if I have legal recourse for their actions. This is a matter of principle for me, and I intend to pursue it diligently.

I called to inquire about refinancing options with BOA. They are my current lien holders on my loan for 5 years. We were hoping to apply for the HARP2 program, but we were willing to go with any program as long as we could refinance. We have never been late or missed a payment. A little bit of history, my wife and I both have decent credit: ~700 each. The only issue we have is that my wife was divorced in 2001. Her decree states her ex is fully responsible for the house they had (mobile). He defaulted on the loan in 2009.
I understand that since it was joint credit, she is responsible, and the divorce decree doesn't trump the loan. But being a valued customer, who has never been late and has sufficient income and a good credit score, you would think they would work with us--refinance a customer they know has been good. But oh no, they would rather sour this relationship for the rest of both of our lives for payments they will get for the next 3 years, when the rules state it is not on the record.
Beware all in this situation. No short sale or foreclosure on anyone's record for 7 years. Now have more dings on credit because of credit report being ran and cannot even buy a new house because of this.

I was one of the Country Wide people. Then BOA got a hold of my loan, took over my homeowner’s payment and created an escrow account all without my knowledge. I am supposed to have a 30-year fixed rate mortgage with the first ten years being interest only. It was supposed to reset to about $500 a month. I was ill and late one month and somehow it bloomed into four payments behind even though I was making payments. Phone calls were useless. I have forwarded them so many documents I bet I have used a ream of paper.
They keep passing them to someone else because you don't qualify and the documents are too old so we start over. I finally got current on the mortgage and asked about the payment after the 10 years was up but they gave me the run around. No one knows these things. There is a formula they use, etc. I have reduced hours due to illness and collect Social Security and at one point they told me I would have to clear $500 more a month before they could do anything for me.
This has been two years going on 3. They took the money but are not willing to help people. My home is now worth $38,000 less than the mortgage. This people should not be allowed to review people’s mortgages for modification. If I could I would refinance, but they trashed what wasn't a sterling credit record of 700 and I don't know if it can ever be rebuilt. They have caused undue suffering, panic attacks and aggravated my heart condition. I wish I could sue them for the suffering they have caused.

Today at 9:12am, we went on-line to check our mortgage account with Bank of America, which I do at least once a week. After logging on with my pass code, the site asked for my debit card information (with the code on the back of my card), and my driver's license number? So when called to find out why the rep states she doesn't know, she thinks this information is necessary to sign on. (?) So, I call the corporate office and was given a Sophia (who states her title is an officer) I did not know that was a title, officer of what?
Anyway, no help. So, we are writing you for you to explain to us why credit card and our driver's license number is needed? We do hope you know because as a customer we feel we give you enough money for as a customer information on our Mortgage Company site should be Free! We could be wrong but try to explain please. Zero is my true rating. My experience in refinancing my existing home loan (assumed by BoA when Countrywide went under) is like everyone else's. I paid the appraisal fee of $400 and sent in all required documentation on multiple occasions. I called and made many, many attempts to contact my loan officer to no avail. I left phone mail messages with my number asking for a status of our refi, nothing. I then went to her manager and left multiple voicemail messages for her along with my number to please call me, nothing.
I then contacted BoA mortgage department and asked for a status of my loan and was told that they could not tell why it was not progressing. I was sent a note rating their service after I called into customer support and completed the section outlining the issues that I was having with "Karly" my loan officer. I never received a call back, email or any correspondence from BoA. This went on for over three months and nothing. I finally called in again and raised hell and was finally told that my loan was canceled by BoA for failure to send in required documentation which is total ***. I have the faxes and transmittal pages showing when and what was sent in. This was a total scam and I will never do business with BoA again.

I have had a horrible experience with BoA. I was tricked into applying for a loan modification. The salesman Jeff said that it was a simple process and they needed $660.00, would close in 30 days. Then the fiasco begins. Keep in mind that I have never been late on one payment, this was their idea. The house happened to be in an LLC and they needed 35 pages of the LLC docs. After faxing several times, they always claimed they did not receive them. They had me talking to Angela 1 about all this stuff and after a month with her and failed transitions, Angela 2 steps in and claims that I did not need to be dealing with Angela 1 because I had chosen my own lawyer.
Then I began dealing with Angela 2 and began faxing upon faxing. She stated the docs went to Florida and then got emailed to Missouri, so I began doing this process over and over. Never got all the docs. Finally, with the help of Jeff and many threats, she finally received the docs. Then today I got an email from Angela 2 that the docs are not in and if they did not get them by the end of the business day, they were going to not approve the loan and I would lose my deposit. Funny how they sent that by email, instead of phoning. Then I started calling Angela 2 and her phone would not work.
After going through all this fiasco, today Angela 2 said she had all the docs but still having trouble with the LLC and I need to take it out of the LLC and put it in my name through a quit claim deed. But she did not know if this could transpire or not. So why worry me for 2 months to mail the LLC docs in hopes of getting me to quit? BoA is a huge scam artist.

In 2004 my husband and I paid off our home with Bank of America, a loan obtained in 1990. They sent us a lien release, unfortunately the lien release was fraudulent, not on the home we paid off in full. Wells Fargo found this out in a title search now, we have been fighting with them for days, and now I have had to retain an attorney. They still have their lien filed against our home even though it was paid in full in 2004. The worry over the last week has made me sick. They do need to be held responsible for acts such as this.
Every American needs to be made aware of this so they can check that their Lien release is correct, and not filed on another home. How can this happen or be allowed? We need protections in place.

I am disgusted at the practices Bank of America has with their mortgage customers. I am a hard working, self-employed business owner. I create jobs and do my part to be a law abiding, tax paying citizen. I pay my bills and I have never been unemployed a day in my life. Last February I contacted Bank of America to see what my options were for lowering my mortgage payment. Thanks to our President (Obama), the money I made in my business was cut in half due to government regulations his administration put into place. With the over $40,000 of equity I have in my home and my history of on-time payments, I assumed I had plenty of options. I was told that Bank of America did not offer me the option of refinancing and that my best bet was to try to do a loan modification. At the time of my call I was not behind on my mortgage. I was told I could not be considered for this program unless I got behind. I did make payment of my principal (at their direction) and continued to do so for the next few months.
During this time I was sent a packet (actually I was sent about 10 packets) of information to complete the loan modification. I provided BOA hundreds of pages of documentation that they requested. Mind you, the only time I knew they needed more documentation is when I called; they never call or follow up, just keep sending packets. After hundreds of faxed pages, dozens of mailed packages and countless phone calls, I was told that my paperwork was "misplaced" by the person working on it and that I would have to send it all again. Which I did. Then, I was told that I didn't get it to them quick enough so they closed my file and would not consider me for the loan modification because of this. Are you kidding me? Great program, President Obama. So now I am short on my mortgage payments, have had my credit affected, and have been left hanging out to dry. Add to this that I have had payments returned to me, payments in limbo (unapplied or applied at random to my escrow account), full payments accepted--a complete mess.
I have spoken to at least 50 different people throughout this ordeal, one more useless than the next. Now, almost one year later, I thought I was close to resolution. Yeah, right. I spoke with two different "Home Retention Specialists" about loan repayment. I was given two different amounts to pay them to get my mortgage back into good shape. The day I called to notify them that I was going to send payment, I was told I had a designated person to work with and that my amount was once again different. Of course this new amount was higher. I bit the bullet and pulled together over $9400 and spent over $30 to overnight these funds as I was told they had to be there in 24 hours. Guess what? I got a call from my "designated person" several days later telling me that this was not enough money and that I had to send another $400. Which I did, not happily but what choice did I have at this point?
Last week I received my check for $9400 back in the mail. Last night, in front of my children, I was served with a summons from the attorneys BOA employed to squeeze more money out of me and try to take my house. And today I received my check for $400 back.
I have never in my life been so frustrated and so thoroughly disgusted at how this is allowed to happen. I have made more than reasonable efforts to rectify this matter. I have been jerked around, lied to, misled, deceived and ruined by Bank of America and they could care less. There are supposed to be laws in place to protect people who are trying to do the right thing, like me, but instead the laws are protecting corporate greed hogs like Bank of America. It is unfair and unjust and I need them to be accountable.

We qualified for a loan modification late in 2010 and went through the trial period during January-March of 2011. We received a letter early in May congratulating us on completing the trial period successfully. We completed the required documents to make the modification permanent and have made the stated payments on time. However, B of A continues to show the old terms on the monthly statements. We called about this several times and were told that it just takes time for the new terms to be reflected on the statement. This week we were contacted by a company contracted by Bank of America to try to help us keep our home!
Now a B of A rep says that they have no record of having completed the modification program. We have faxed the paper trail to them and hope it will finally get straighten out. But after having read many other posts on this site, I'm starting to think this is a systematic effort on the part of B of A to stonewall modifications. They have reported payments that were made as agreed since the modification to the credit bureaus as late. And if they don't get their act together, the likelihood is a foreclosure even though we've made all payments as agreed.

I applied for a home modification loan and received a three-month trial period. I was able to make the payments and I thought everything was okay but BOA sent papers to be signed. I never received them. I called and told them, BOA said that me they'd send new ones but they never did. I called; they resent and finally I got it and sent them back on the same day but modification was called off. I may lose my house now because of their screw up! I can't pay 1159 dollar mortgage.
I am on disability and the modification takes up all of my check. I did everything they said to do! They are the ones responsible for the papers not getting done sooner. When I first told them I never got the papers, they never resent them. I called again and they gave me a song and dance and sent again!

I will make this short and sweet. I need an attorney who is not afraid of Bank of America to help me sue them for a derogatory loan, bad modification (including adding on illegal late charges), overcharging me for a year on my modification creating a further hardship, and instead of reimbursing for overcharging they kept the money and applied it to next month's payment. I was promised a new modification, on record I might add, due to the last one being not good; and low and behold, I was told I was denied because I can afford my mortgage as I am not late. Well, I have been late the last five months in a row so I don't know what in the heck they are looking at! I have been fighting this since 2007 with them and Countrywide, to whom sent me a check recently for $100 from a class action suit on PMI being bad (which I have not cashed yet due to the reasoning behind it).
Well, that is great but my PMI is still bad at $589 a month—yes, a month. Do you have any suggestions in FL that will help me? I know I have a good case, but I just need someone to help me push it through. I appreciate your time in reading my reader's digest version and any advice you can give me. This bank needs to be stopped. We have wasted billions of dollars to do these modifications. The government should have just made our payments for us. The banks are much richer and the homeowners are homeless! I will lose my home without this modification which the bank will still be making a ton of money on.

Tried to refinance. Bank of America told me to do a modification. That was the start of my two- year nightmare. I have sent documents they requested over fifteen times. Always the same thing over and over. If they would of just refinanced me, it would have never got to this point. Now my credit is ruined and I am losing my house. Why does the government let this sadistic bank operate this way? They need to be stopped. Wish I would of refinanced with a different bank. I hate bank of America aka the devil.

Should be zero. BOA has strung us along for 27 months to see if we can qualify for modification. I only needed it for an initial 6 months period until I was out of school and could work full-time. But they managed to lie, mislead, put-off, contradict, not allow us to pay any payments (except the full past due amount including interest, late fees, uh. I need help, fool), and prove they have no clue what they are talking about or doing. I have begged, pleaded, tried, yelled, cursed, shut up my blood pressure, cried, called, written, faxed, emailed, questioned, and remained in shock of BOA's tactics.
I was given hope then shut down. I was given incompetent employees including supervisors. I called every area of the world, Texas, Costa Rica, California, you name it and no one in hell told me the exact same thing twice. As of 01/03/12, I was told no workout is possible because the loan was 27 months behind and basically that's Fannie Mae's guidelines. That's it. After 27 months of this fiasco, I was told that I was refused for modification because it had been 27 months... that they had caused with lies and deceit. Please, someone please tell me how to fight these people when money for attorneys is not exactly an option for me!

B of A recently sent a notice that any mortgage payment received for less than the required amount would be returned to sender. I paid my mortgage in December and sent $2000, apparently I owed around $100 in fees and the required payment was closer to $2100. Instead of crediting my account the $2000, I sent them and asking for $100 more on my next payment, they returned my payment to me a few weeks later.
It seems to me as if B of A has no interest in me paying off principle and is more interested in creating late fees and missed payment fees while watching my credit suffer. While I understand they sent a letter explaining this would happen, it doesn't make it right. People are trying to make their payments. Why not credit the money they send to their account? I'm now required to make a $4100 payment but I'm now late on the previous payment causing me a fee and the potential of damaging my credit.

I applied for a meeting refinance on 10/17/11. On 10/24 the appraisal was completed and faxed to Melissa on 10/27. I was charged $400 for the appraisal. In early November, Stephanie **, Retail Manager, told me the loan was approved . Still no word from Melissa. The end of November, I contacted both Stephanie and Melissa to see where the loan was at. Melissa returned my call to say she would try to get to it by December 15th. I did not receive any more information on the loan until January 3rd.
I received an email from Melissa telling me that she needed new statements, HOA info and other paperwork as these items had expired! When I opened this with Stephanie she informed me I would be charged for the appraisal but with a quick turn around I would payoff my credit card. I told her I did not want any credit card debt. I was charged by the end of October and have been making payments since. Also, I have a Home Equity Loan that was not going to be paid off, but, Melissa neglected to inform the Title Company of this and the Title Company ordered a payoff on the loan and thus my Home Equity Loan was closed.
I called Melissa and Stephanie about this, they said it was not their concern, that all I needed to do was pay $95 for the Subordination letter and the loan would be reopened. I asked my Credit Union if this was true, they said they would not reopen the loan, I would need to apply for a new one! After I received the email telling me all paperwork had expired, I cancelled the Refinance with Bank of America. Bank of America holds my mortgage, I have never been late or missed a payment.
I thought this should be a fairly simple ordeal just wanting to get in on the low interest rates to help save a little money! I will never work with Bank of America now or in the future since this seems to be a great example of how they treat their customers!
I did not get the refinance as I cancelled the application. My credit card was charged for the appraisal of $400, which I am now paying off. My Home Equity Loan was closed do to lack of communication between Bank of America and the Title Company plus all the frustration I have gone thru trying to get these people to just help get this loan processed!

I currently am dealing with Bank of America regarding foreclosure. I am physically and emotionally drained due to the fact that Bank of America has not been very cooperative with my ordeal. Me and my husband have worked all our lives and for the first time on June 26, 2010 we became unemployed. We continued paying our mortgage the best that we could, but come May 2011 we were really struggling. We decided to contact Bank of America to find out what options we had to help us pay our mortgage. I was offered the modification application which was filled out and sent with attached documents.
We begin working again in September 2011. After several calls with no answers, finally in November we find out through an attorney that our home is being foreclosed. I called continuously and sent faxes and nobody had answers. My home was due for foreclosure on December 6, 2011 without any notification. I decided to call an attorney due to no response from the bank and he advised he would put a restraining order until we could figure something out. We went to court and nobody from Bank of America showed.
I have called and tried to figure this out but it has become impossible because nobody knows anything. I was advised that my modification was denied yesterday and now that's the end of any answers. I was told in the letter that the modification was closed because they are unable to verify income. I sent everything! I am making enough money now to send what I owe but nobody gives me any answers. I need your help, please. I am not going to lose the home my family has dreamed of. I am not denying to pay but please I need someone to give me answers. We are scheduled for court on March 19th to find out what is going on. I wish this nightmare would end and I could be at peace. This has caused severe emotional and physical distress I want answers, please.

After many attempts throughout more than a year trying to modify my house payments to get back on track, I lost my house. My house was in El Paso, Texas. My younger sister, single mom with four young children ages 1.5, 5, 8, and 10 were left without a home. Worst of all, right before the holidays.
The "reason" I was declined on all attempts was "lack of documents". I did submit all documents required at all times. At the end, B of A was supposed to postpone the sale of the house scheduled for Dec. 6th, 2011, but it didn't happen. While I was still waiting for a response from B of A, which I never got on time, the house was sold on that scheduled date. Then, I wrote to the CEO and I did get a response, but I was given too many excuses, "guidelines and deadlines".
Funny and interesting fact is that I received a letter (after speaking to the CEO advocate) with choices on what decision to make regarding the house. "Are you kidding me?", that was my thought. I also, just yesterday, received a call and a message from the same person for a "follow-up". This must be a joke! They have sold my house to Fannie Mae on Dec. 6th of 2012! I don't own the house any longer. This only shows that they have no clue on what they are doing! I would like to know if there is a lawsuit going on against this institution that I can join. Maybe we can stop this mess and keep other people in their homes!

My name is Jose ** and I had a home at ** Mission Viejo, CA 92691. All supporting documentations will be attached bellow. For approximately a year and a half, I have been applying to try and get a loan modification with Bank of America. The process was really tough, because in the beginning, you didn't have an assigned case manager, so it was tough to get any updates from them. I recall that I had to resubmit paperwork several times, because I was told that after 30 days the paperwork got old.
After several phone calls, and pleading with Bank of of America, I received a personal case manager, Angela **. She told me that Bank of America changed the way they do business, and that now, I will have her as a contact person to get me through the process. Everything appeared to be going well. She told me that as long I was in the process, my home would not get sold. Per her request, I faxed over the last of the documents that she wanted on October 24, 2011. Angela ** told me that all my documents were in on time, and that they were being sent to the underwriter.
On the same day, October 24th, I was notified that my house apparently had been sold at an auction. I quickly notified Angela ** at Bank of America, and when she did respond, she told me to disregard the notices, because my paperwork was in on time. She said "I was trying to get you an answer on the notice you received. I showed it to my manager, and she said disregard the notice, because you got all of your documents in on time. Sorry for the delay".
During this process, I kept getting phone calls and notices from an REO Broker, Michelle **, who is the representative of Alton Holdings Inc., the company who apparently purchased my house. Because I did not want to lose my house, I filed a complaint with the OCC-Treasury Division of the Federal Government, requesting that they look into my case, because I didn't think Bank of America was handling my situation properly. Shortly after filing my complaint with the OCC-Treasury Division of the Federal Government, I received a call from Tammy **, who told me that she will be my new case manager, and she worked at of the Office of the President of Bank of America.
Tammy ** and I had several telephone conversations, where I was assured that the sale of my property was a mistake, and that Bank of America rescinded/cancelled the sale. Tammy even gave me the number to the Recon Trust Company, who apparently were instrumental in the sale of my property, and the information I received from them through a recording, was the same information that Tammy ** received, the sale of my house was rescinded/cancelled. She wrote to a Joy **, "can you please provide me an update on Jose **. The recession appeared to be approved. I was proceeding with the modification. He received an email from Michelle **, **, saying that it was rejected. I'd appreciate any updates you may have. Mr. ** is extremely upset. Recon is saying the sale was cancelled".
Tammy ** reassured me that everything was fine, and that she was proceeding with my loan modification. She told me that I should be receiving my loan documents soon. She went on to tell me how the loan modification program was going to work for me. She said I would have a 3 month trial period, to make sure I could make my payments, and then the loan would be permanent. I was really looking forward to getting the help I needed. Shortly thereafter, my communication with Tammy ** stopped. As you will read in my supporting documentation below, I have been trying vigorously to make contact with Tammy ** and her coworkers, to try and get answers, only to have my request ignored.
On December 22, 2011, I found a notice on my door, telling that I need to be out of my house by Wednesday, December 28th, by 6AM, or I will be forced out by the Sheriff's Department. The plaintiff on the notice is Alton Holdings Inc. and I was named the defendant. As you might imagine, this was very upsetting to me. On December 27, 2011, I sent everyone involved with my case the following email that really sums up my whole situation to this point:
It's December 27, 2011 and just a few hours ago, I was paid a visit by the Orange County Sheriff's Department reminding me that I needed to be out of my house by 6AM tomorrow. I told the officer that I would be out, and that I was trying to clean as much as possible. As you probably know, I am as disappointed in the whole process as one could be. I was lied to, misled, and all by the same people who were entrusted to help me. To all the employees at Bank of America, the system has apparently failed yet another United States citizen, me, Jose **. I did everything that was asked of me in the time that was allotted, and I still apparently lost my home. As far as I know, I am still in the loan modification process, and there is no valid reason for me to get denied, because before this hardship, my credit was impeccable.
Tammy **, you promised to communicate with me on a daily basis, and you as you can see you failed to keep your promise. Why you would lie to me, is unknown at this time. I have requested help from the Federal Government, the Office of Congresswoman Loretta Sanchez, and tomorrow, I will be contacting Senator Lou Correa. I will also be meeting with my attorneys to discuss how to proceed.
Michelle, I will be leaving the key under the doormat, in case you would like to pick it up. For unknown reasons, Bank of America reps told me that you were lying to me, and just were out to make a profit. As you know, they assured me that the sale of my home was rescinded. Apparently, it was not. Everyone at Bank of America has apparently abandoned me, and they won't even return my emails or calls.
As a citizen of this great nation, one that I support and fought so hard for, keeping the peace and enforcing it's laws, I am saddened that I was treated this way. I hope, at the very least, all of you enjoyed your Christmas with your families. Hopefully next year, I will be able to enjoy mine. I am saddened that I had to spend mine cleaning out my home. In closing, I did everything that was asked of me, in order for me to save my home. There were many options on the table for me, but I didn't get a chance to exercise those options, because Bank of America assured me that my loan modification was accepted. I was with the underwriters, and I would be getting my new loan soon. I was also assured that the mistake made when Bank of America sold my home was corrected.
I am going on my 4th day that my 13 year old son and I, were forced to leave our home, and we are struggling greatly. Bank of America continues to ignore my request for dialogue. I respectfully ask for your assistance in this matter and I hope to hear from you soon.

Two months ago, I requested either a refinance or mortgage modification. I have never been delinquent or made a late payment. However, within 2 days of my request, BofA restricted access to my online account so that I am unable to make my payment. I was informed by a customer service representative that once you request a modification, your access is immediately restricted regardless of whether or not you have been offered a modification let alone even sent the application back to them.
Because of this, I informed BofA I would not be filling out the application and was no longer interested in the modification or refinance. I am still unable to make a payment even though they mailed me a confirmation letter two weeks ago acknowledging I was no longer interested in the program. Bank of America does not mail paper statements, so if you don't live anywhere near a BofA branch, your only option to pay is via phone of which they charge $15 for. As a result, I have created a petition on **, so please sign it to get BofA to stop shady practices for those of us homeowners who need help or just want to take advantage of lower interest rates.

The U.S. Federal Government enacted home programs to help restore confidence in Americans. Why is the government reneging on these policies? The government created programs like HAMP (Home Affordable Modification Program) and delegated/paid the big banks to administer them. Therefore, the big banks have a fiduciary responsibility to the Fed to implement these programs. Big banks don't like these programs and do everything to avoid implementing them. They can and do get away with this dereliction of duty because the government refuses to oversee these "private" institutions. If the banks do not want to administer the programs, give them back to the Fed.
In my family's case, we have been involved in some variation of Fed and big bank ** for 20 months. In the latest chapter, we have been involved with the HAMP program since February 2011. We were granted entry into the program and it’s three trial payments. Finally, hope. We have owned a printing company for 20+ years. It (like many small businesses) was devastated by the inept decisions from the best and brightest of America's finest colleges. Hope. That is what the programs were designed for. Hope is what we were given. With this new hope we decided to try to salvage our business.
We made our three payments. We heard nothing from Bank of America. We made a fourth payment because we had no idea what to do. Later, we received a letter saying that we did not make all my required payments and we were denied the HAMP program. We did and still are contesting this. It seems there was a clerical error. Our payment of $1302.00 was entered as $1032.00; simple transposition error. No, the computer rubber stamps us out. Bank of America says to call for other programs. Bank of America does not answer phone calls, or return messages.
We have left over 100 messages for our Client Service Representative. That is who our account goes to, automatically. Never once has he called back. We have never spoken to him. If we enter a wrong account number, we can get a human, but then get transferred back to the Client Service Representative, and the cycle repeats.
We are now involved with a HUD contracted credit agency to help with the process. They are the only ones that can get through to Bank of America. Any Bank of America representative works with us over the phone on a 3-way conversation and then emails our Bank of America Customer Service Representative and his boss. Four weeks running now. No replies. How is a little person supposed to hold a federally backed institution accountable? Meanwhile, another month goes by, and now into a new year.
When we started the HAMP program, we were one month behind. Now because they don't recognize the trial plan and payments we made, plus their apathy, we are 7 months behind. I fail to see what is missing here. Everybody says to ask for help and yet Bank of America refuses to reply. "Bank of America is insured up to 90% of the loans on homes so when they foreclose on a home, the U.S. government in their infinite wisdom pays them 90% of the loan, then the bank also gets the amount of the sale of the home from auction.
They are making 200% from foreclosures." (A quote from a below post). My husband and I are so mentally drained and broken from all the fighting with them. We will keep on fighting, but thoughts like the above make me wonder if it's any use. And families like mine, who have worked hard for many years, busted our ** to live somewhere safe and in a modest home that we poured our blood sweat and tears into are being tossed out of them like garbage.

My modification was denied twice with BOA and now I'm facing foreclosure. I was given/offered $3000 to move. I am now 12 months behind. They are extremely insensitive and evil. They have no interest in helping anyone because they make money on foreclosures and short sales. BOA is the worst bank when it comes with modification. They string you along until you reach your year mark where FHA won't qualify you, then they'll deny you. I have not met anyone who was approved for a mod with BOA. Sadly, I know and heard of many who have lost and are at the verge of losing their homes. Shame on you, Bank of America. God will deal with each of you accordingly. Nothing lasts forever.

I purchased my home in July 2007 with BOA as the lender. I remained with them until December 2011 when my loan was sold to Green Tree. When I received the notice, I Googled Green Tree and became very afraid of what I found. However, I opted to stay calm and continue to expect the best, but prepare for the worst. Around the 1st of December, I was contacted by a Green Tree representative by phone as a welcome and explanation of payment options. This call lasted 2-3 minutes. On December 11th, another Green Tree representative called and asked if I was ready to make a payment over the phone.
This representative explained that any account that is not paid by the 1st is automatically referred to their Collection Department regardless of the 15-day grace period. This representative explained that if I wanted to avoid this, keep making payments during the 1-15 days timeframe. He could create an electronic payment for a 4-month period that would debit my account every 4 weeks. I immediately accepted, and together, the representative and I created specific dates based upon my pay dates that my account would be debited for my mortgage payment.
He also explained that I needed to call them every 4 months to recreate the electronic payments. Also, he explained that this method would place me 2 months ahead of my mortgage by December 2012. I received tracking numbers, exact dollar amount (including a $12 processing fee), and specific dates for each electronic payment. Bank of America NEVER DID this. I wish they had because by now, I could be 4-5 months ahead on my mortgage. Over time, this could have shaved years off of my 30-year loan. Plus, the transferred paperwork from BOA did not include copies of my insurance information. Green Tree sent me a letter informing me of this outstanding requirement.
I immediately contacted my Condo Association and faxed the paperwork to Green Tree. The next day, when I contacted Green Tree, the representative was able to locate my paperwork by using the fax number and the Association’s name. I was placed on hold and the representative informed me that the paperwork was in order and she had integrated it into my file. BOA never asked for proof of insurance.

My husband and I have been B of A customers for 41 years. We were contacted by the bank at the end of Oct 2011 to refinance our loan, making our payments about $700 less per month. We received the initial application paperwork and sent all the documentation to Tampa, Florida by the first week of Nov which included our 2010 tax returns (remember this for later). An appraisal was completed soon thereafter, appraising the house at $680,000. Our loan is approximately $380,000. Our next contact was with the loan processor, asking if we had received the notice of incompleteness, to which I responded no. She gave me a list of documents over the phone that I needed to provide within 10 days from the notice which I hadn't received yet, giving me three days to comply.
When my mail came that day (Nov 17), there was the notice of incompleteness dated Nov 10 in an envelope postmarked Nov 14. Why it took B of A four days to drop this notice in the mailbox is beyond me. I gathered all the requested documentation and FedEx'd it Priority Overnight, with an arrival date of Nov 21. I left several voice messages after that asking whether the information arrived and if it was what B of A needed. I received no call back.
The next contact with B of A was Nov 28, wherein our loan processor told us the loan terminated because the property was vested in a partnership name. After speaking with the loan processing manager, he said to vest the property in our individual names. We went to the recorder's office the same day, changed the name on the title, FedEx'd the conformed copy to the title person at ValuAmerica, then received an email from him stating, "We received the okay from the underwriter." Now, it's Dec 7.
The next letter from B of A was a Notice of Action Taken stating "Title cannot be vested as requested." This notice was dated Nov 29, in an envelope postmarked Dec 14, arriving on Dec 16. Another instance of a letter sitting on someone's desk, this time for a period of two weeks. My husband and I began making multiple phone calls to our original loan processor and her two supervisors, always getting their voice mail saying they will return our call within 24 hours, which never happened. What we got was a phone call from the salesperson who we originally dealt with saying the loan was probably terminated too quickly and all we should have to supply are current bank statements.
Within a few days, we received an email from the salesperson saying he had spoken with the loan processor and she had a list of documents we needed to supply. Turns out the documents she needed were the same documents she received on Nov 21. After several phone calls to the loan processing manager, none of which were returned. On Dec 27. we received a phone call from the salesperson saying he had spoken with the loan processing manager and our "debt-to-income ratio" was too high. The salesperson said he had the same numbers and didn't think the processor's analysis was correct but maybe we should start the process all over with a "fresh set of eyes."
The next day, the salesperson called and said he had again spoken with the loan processing manager and he had "bad news." In our 2010 tax return, our adjusted gross income was too low to qualify for the loan. My question is if this is really the reason for denying us, B of A had this information from day one. Why didn't they reveal it then instead of leading us down this path of frustration and exposure to incredible incompetence on the part of their employees? Does the bank even take into consideration the fact we've never missed a payment on the current mortgage so why would we default on a payment that's $700 lower? There's some serious harassment and game playing being perpetrated by the bank.

My rating is actually a big fat zero for BOA but I had to put something to get this through. My complaints are the same as all the others listed on your site. I refinanced my mortgage and at that time was told it was an A.R.M but as long as I refinanced it within 3 years, it would be no big deal. Well when my mortgage was due to reset, I attempted several times to refinance however, I had no equity left in the home so a refinance was impossible.
My mortgage went from $1200.00/month to $3345.00 per month after my loan reset in 2009. I did everything right! I went to CCCS of NH/VT for credit counseling - worked out a monthly budget and worked with their HUD mortgage person who contacted my mortgage company at the time, Wilshire, who worked out a monthly trial payment. This trial payment was for 3 months (HAMP/HAFA) and as long as I made my 3 payments on time by the 1st of every month, my loan would be remodified to something I could afford. My 3 month payment was $1270.81 (a % of my income) the first payment was to start 1/1/2010. I started this payment on 12/1/2009 (a good faith effort on my part). I made every payment as agreed. Mid March of 2010 I received a letter from BOA stating they bought my loan. My first payment of $3345.00 was due on 4/1/2010.
I called immediately and discussed the agreement with the previous lender (I had no idea BOA was buying my mortgage or even that it was being sold by Wilshire). They assured me everything would be just fine - "please resend us all the paperwork you send to Wilshire so we can process your re-modification”. I faxed (received confirmation) all 42 pages that next day. A week later when I called to see where it was in process, I was told it was never received. I re-faxed it and again, received a fax confirmation. I called that afternoon and was told it was received and would be processed ASAP and was encouraged to call back weekly to check the status - to which I did for almost 6 months.
They kept telling me, "Don't worry, it's in process - we don't have many officers to process the number of applications coming in so just keep calling". I started calling monthly and the story was always the same - "it's in process" or "the person who was processing it is swamped so we've sent your application and docs on to another representative, but keep calling it will be processed soon." This went on for over a year. Then I got a letter in April of 2011 stating that my loan is being foreclosed due to my account not being current. I called, was told that I was 18 months behind. Mind you, I'd been making the agreed upon payment of $1270.81 every single month since the agreement was. I told them I was going to keep my end of the agreement and keep sending them the $1270.81, they could do with it as they chose but I gave my word as did my previous lender.
In June of 2011 I received a check for $3500.00 which was a reimbursement for my partial payment in December 2009 (BOA didn't even own my loan at that time). They also said I didn't qualify for HAMP/HAFA. I went to the CCCS of NH/VT and met with the same man I met with in November of 2009 when my loan was due to reset. He told me I still qualified for HAMP and he couldn't understand why BOA was saying I didn't. I deposited the check and per my usual, sent them my July payment to which a week or so later was deposited back into my checking account. They were now refusing my monthly payments - my agreed upon monthly payments. After several months of arguing the point with them, harassing daily (in excess of 5 - 8 times per day) phone calls from them at my work, I decided to get in touch with Senator **.
She/her office (Colon Pio) has been absolutely wonderful - while she's/they've not been able to save my home she's/they've been very instrumental in staying on top of BOA and the Short Sale process. I am not happy about being forced out of a home I raised my family in for 15 years. I'm not happy about being jacked/robbed/harassed/belittled/berated by BOA. These people are ruthless. The only reason they are still in business, in my personal opinion is because they sucked off the ** of America and took money from the American people to dig their own ** out of the pile of dung to prevent bankruptcy and foreclosure of their own faltering, poor decision making ignoramuses.
See that's the difference between BOA and the average American struggling homeowner, they get a "hand out" from the Federal Government (here big bank of poor decision makers - here's a bailout) and we, the homeowner get a hand out of our homes. Kicked to the curb with a smug look and a finger up the wazoo - ain't that a fine, "how do ya do?", I say we all get on the bandwagon and sue, sue, sue! Where is my bailout? Where is your bailout? Oh wait, that's right, Bank of America got it and your house too! This bank has cut off its nose to spite its face! Greed, greed and more greed. I hope they go under, way under. It's a feeling that robs you of who you are, who you've worked hard to become and is a real kick where it counts.

I have had the same experience that the rest of you had. I have been going through this for 6 months. Making Homes Affordable states that it is for people who are current, which we are. It is getting tougher though, with the drop in my business. Always the same thing, and new people to speak with. I faxed documents 12 times. I do not understand that there is no one to speak with, about their tactics. I am very frustrated.

My father's house went to trustee sale on December 22nd, 2011, no bidders and so it went back to Bank of America. Here is the strange part. We had an offer from a buyer one month prior and Bank of America countered the buyer one day prior to the auction! The assigned representative to the file told my dad two days prior to auction that she would postpone the sale and our agent reassured us the house wouldn't go to sale and get postponed.
Our home of 20 years got sold and by direction of Bank of America, we need to vacate our home preferably within weeks.

Due to the loss of my second job and my spouse leaving, I am unable to pay the full mortgage payment. Nonetheless, I kept paying it while I could and I asked the bank for help. As long as I paid, they didn't care. So I stopped paying and that got their attention. I am a year behind in payments but even so I am not underwater on my mortgage. I have tried to get a modification for my home loan for 22 months now and I am back at square one for the 5th time. My brother is a mortgage broker and I have an attorney working for me who has modified many loans. They assured me that I qualified for a modification according to the formulas. However, they both warned me that Bank of America was the worst at modifications. Every time I seem to be making progress on the application, my case gets reassigned and the new person wants all the same paperwork over again.
In August of 2011, they sent me a letter thanking me for my application and stating that I would hear from them within 20 days. Well, they lost my file for over 70 days. They could not give me an update until the newly assigned manager and I finally spoke on the phone. Is it a coincidence that I am now more than a year behind on payments and I will no longer qualify for a modification under FHA guidelines because I can't be behind more than 12 months? I feel that Bank of America intentionally ran out the clock on me. This can't be accidental. The new manager said that the documents expired and I need to start all over. I am so sick and tired of this game. The new persons never know what you have been through and just give you the same old run around. I have had it with Bank of America. I will try for a short sale and then let the process play out.
Since I am not underwater, they lose nothing. I guess they are happy to lose customers. Friends of mine have modified loans with Wells Fargo and Citibank in less than 6 months. Bank of America just doesn't care. I hope they get a class action suit filed against them to reveal the systematic abuses they perpetrate. It seems that the employees are all making minimum wage. Their lack of enthusiasm and lack of knowledge is on display every time I call. Bank of America is indeed a ship of fools.

These people do not deserve a rating. I would never have a mortgage with these people again. When my husband was laid off, I called and was told I would qualify under the Home Affordable program so I applied and then I kept having to submit the same paperwork over and over. The last time I emailed all the paperwork to the guy who was supposed to be my contact and he did nothing. So finally, I got a letter saying I didn't respond in time so I was dropped from the program. I have sent multiple compliant letters to BOA and they really don't care. I then meet with an actual live person at one of the outreach centers and the service is just as miserable. I am still waiting for her to get back to.
This whole thing with helping homeowners is nothing more than a joke. I have done everything I can and now I am out of options. I have been sacrificing everything to make my payments. I can't afford to ruin my credit because my husband is in finance so that would look bad. What I want to know is how you get help you need because it won't be from BOA.

I fell behind by one month on the mortgage payments due to disability during the summer. Then hurricane Irene hit and I was out of a job for 3 weeks. (Nj was declared a national emergency by Obama/Fema). I am able to make my payment but cannot get current to have my monthly payment paid by the grace period of the 16th of the month. I have contacted Bank of America more than 20 times. I have spoken with countless amount of people and many, many departments. They have no program for people in this category at all.
They have no program for people in this category. I just need to skip a payment and add on to the end of the mortgage or divide a payment into three months to get caught up. They say "sorry to hear you are having trouble but there is nothing we can do, let's send you to another department." I have been through 10 departments with no success. They call constantly and send letters threatening foreclosure if my account does not get current. Then again they say I am current because I do get my payment in, although late for the past 5 months. It's very frustrating going into 2012. We need help now. We bailed BoA out and this is how we are treated as a society. It's absolutely heartbreaking.

I am a BofA mortgage customer because of the Countrywide debacle. I have never been late on my mortgage. This past October, BofA notified me that they would be selling my (servicing) loan to M&T Bank. M&T sent me a letter telling me to send my December payment to them if made after 11/16/11. M&T cashed my December payment on 11/28/11. BofA sent me a letter on 12/06/11 stating that they have reversed the transfer of my loan and BofA will continue to be my servicer. I called them on 12/13/11 and 12/14/11 inquiring about my December payment and was told by BofA customer service, "Not to worry, due to the transfer, RESPA guarantees that BofA will not assess late charges nor will they report to a credit service regarding this payment."
On 12/20/11, I received a call from BofA's collections department notifying me that I was late on my December payment and that I needed to fax in all documentation proving that I had made the payment to M&T Bank. I have done so and I have also sent a certified formal letter to BofA's payment research department requesting that they stop the process to alert any credit bureau of a late payment, per RESPA. I have continued to get calls from BofA's collections department, each one speaking to yet annother supervisor informing me that they "cannot guarantee that late fees will not be assessed." They also refuse to send me the January statement because the December statement has not been satisfied and they cannot interrupt the process.
In researching RESPA, I am absolutely appalled by the lack of protections for consumers/borrowers. Even if BofA is found to be in violation of RESPA, there is little to recover and much to continually have to deal with when applying for future loans, i.e. HARP refinancing. I would like BofA to immediately fix the mistake they started and reinstate my good standing with them, so that I can find another servicer for my mortgage. I am concerned since I live in NV (the foreclosure capital) that they give me little to no respect and have put me in a high risk category simply for living here. I am also questioning the timing of the transfer/reversal due to the HARP 2 program.
I am still receiving calls from BofA's collection department (yet there are new supervisors each time now). They have not applied my December payment made to M&T Bank to date. They have recently sent me a customer service survey via email. I still have not received a January statement and the collections/customer service department cannot guarantee stopping late fees. M&T Bank has no record of me or my loan even though I have letters from them with an account number. I seem to be stuck in some sort of loan transfer purgatory that BofA's "system" cannot interrupt nor stop charging me fees. Worst of all, the federal law established to protect me is useless.

I received some hurricane damage from Irene, and despite all repairs have been made, that I paid for myself, and sent estimates and receipts, the mortgage company had sent their own adjuster out, and said repairs were 100 percent done. The bank is still refusing to endorse the insurance check. I have faxed them all of the requested papers. Some of them 4 times, as they keep misplacing them. I am tired of one person telling me one thing, and then when I am supposed to get the endorsement code, it's suddenly something else, or it's give them 48 hours.
It has been 3 weeks, and I am out of money from my own pocket, as I had to pay for repairs, and mold, and water clean up ASAP, as my son has asthma, and my wife has COPD, and could not be in the house with mold, and their adjuster gave them the okay to sign off at one point. I was told they would only cover materials. This is becoming very frustrating. I have missed time from work, to talk to these people, not to mention the cost of faxing the same documents over and over. It seems like they are trying to blackmail me or something. I cannot take any more of this. The stress has been unbearable, not to metion I have a 5 year old, and he doesn't understand why mommy and daddy are so stressed and angry.

I really don't think that I can add much more to this complaint forum that hasn't already been said. I too have a "new" case manager and he too said that I would be receiving a FedEx package with papers to start our modification. It never showed up! I have been hearing the same song and dance since July. We're in foreclosure status. Finally, my "new" case manager emailed me the forms and I filled everything out, fax info back on both portal fax lines and to my case managers personal fax line. I haven't heard a *** thing.

Each time I do this, I receive an email from the White House wanting me to keep them up to date on my status. I mentioned this to one of the bank's employees and she laughed at me saying that BofA doesn't not have to follow the government's guidelines. I said, "But the government is the one that saved your sorry butts," and she actually said, "Well, we say thanks by screwing the government." Amazing!
I wouldn't work for this bank if it meant I was going to lose everything I owned. They are thieves. Their actions are completely immoral but no one does anything to stop this. Well, I am not going down without a fight. I may not be successful alone but if the people pull together then maybe we could make a dent into this organized crime hoarders. I just wonder what the CEO will be bringing home this quarter in bonuses.

I lost my job in 2009. Depleted savings and retirement making house payments until earlier this year. Have repeatedly asked BoA for short sale or restructuring of loan with no response.

I could not believe it when I was thinking I could get help to lower my payments. I read the website and I sent in all of my papers and I was shock Bank of America did not do anything to try to help at all and all the bail out money was giving to this company.

I have a VA loan through Bank of America. I've been making my payments the same way since I first got the home loan two years ago. I pay most of the money on the 1st of the month and the remaining balance on the 15th. All of a sudden and without notice they stopped taking partial payments. Instead of crediting the money back to my account they chose to mail a check back to me during the Christmas season. The best part is they waited to send my partial payment from the 1st until after I had completed the payment on the 15th.
Their collection department has been calling me 5-6 times daily asking me for a payment. Today is the 27th and I'm just now getting the payment from the 1st of the month back and now have to wait until I get the check from the 15th back as well. When I tried to reason with them they basically told me I'm stuck with the late fees and that if the payment is not made before the 1st, it will be reported to the credit bureaus that I was more than 30 days late on my payment. (The only reason there's one star is because you can't pick zero).

My nightmare with Bank of America’s Making Home Affordable Program started in March 2010. 2009 was devastating for the construction industry and many of us began to struggle and fall behind. I managed to scrape by until the spring of 2010 when my saving, pension and unemployment ran out. After becoming 2 months behind ($2800) on my mortgage I received Notice of Intent to Accelerate. Shortly afterward I received a mail informing me that I was selected to participate in the Making Home Affordable Program and to start paying a reduced mortgage payment.
Of course I thought this was great! I found a new job about the same time and felt confident I would be able to make the trial payments on time. My old payment was about $1400 and the new payments were about $850. My old jobs paid above $25 per hour; my new job paid $18 per hour plus overtime but is more seasonal. I only work 9 months of the year at the new job. Bank of America would ask me periodically to update my financials during the program.
After 8 months of paying into the program I received another Notice of Intent to Accelerate. The notice stated that I now owed over $8,000. I was shocked! At the outset of my being entered into the program I was unaware, that if I was denied my modification, I would be held liable for the balance of the reduced payments. This includes miscellaneous charges and fees. It was never stated over the phone or in writing that this would be the consequence. This program has turned from an opportunity to help the struggling homeowners struck by corporate greed, into the final devastating death grip of predatory lenders. The modification evaluation process is done behind closed doors. These decisions are devastating to 80% of the borrowers whom have entered into these programs. At the very least the bank should be required to send the Net Present Value (NVP) report used to determine their denial to the mortgage holder. The mortgage holder shouldn’t have to request it. The bank most likely has destroyed it anyway.

I refinanced my mortgage in October 2010 to lower my interest rate. I signed documents with Spectra Funding. Bank of America became my loan servicer. I do not wish to do business with BOA. I never signed any agreement or documents with BOA. I pay my mortgage payment in two installments so as to reduce the amount of interest paid over time. These payments are drawn electronically from my bank account and directly to my mortgage account with BOA via a service my previous and current bank provides to its account holders. This service is free.
In December 2010 I found a rental here in NY where I am from originally and returned to after my husband’s death. I was able to find work here after only a month. I still own my house and property in Somerset County, Maryland. There is a nice couple and a baby renting my house right now. I am not turning any profit on the rental. In January 2011 I received the first calls from BOA claiming I had not paid my mortgage. When I gave them the correct information and they checked my payments received, they informed me that they had applied them incorrectly to my mortgage payments. They told me at that time that they would require me to open an account with them in order to pay my mortgage in such a manner. They also explained that if I did not do so, they would still accept my payments this way for a monthly fee.
I will not pay a fee to save long term costs on my mortgage, and to use a service provided to me for free by my bank account holder. Furthermore, I will not be forced to open an account with BOA, whom I do not wish to do business with in the first place. Every single month I received multiple calls where the agent told me I had not paid my mortgage and over course of a few days BOA would make the necessary adjustments to fix the problem. I repeated again and again that they must re-calculate my mortgage to reflect the proper application of my payments. They would create an account to hold my money in interest free, and apply it when they had received the maximum benefit from my monthly amortization.
I filed a complaint with the OCC, which is still pending. Status is complaint received, review in progress. In September 2011 BOA began sending me checks for half the amount of my mortgage payment. At the same time, they had begun calling multiple times a day, every day, for the last two weeks, making collections calls that state I have not made my mortgage payments, despite having the electronic confirmation from my bank and theirs that they in fact have been receiving my payments without interruption. The agents have made multiple fraudulent excuses why I cannot pay my mortgage in this way, all of which ending in either my paying them or opening an account with them, contradicting the sometimes laughable reasons they give for being unable to comply with accepting my payments. They have now threatened to make fraudulent claims against my credit that I am in default, when they are sending me checks for my mortgage payment that is electronically transferred to them for free. I discard these checks. I will not stop paying my mortgage.
I have contacted BOA repeatedly in writing to dispute this costly fraudulent activity concerning my mortgage. I have had repeated conversations with agent after agent during their harassing phone calls. I do not have the time nor patience for this. I consulted my attorney who relayed the following information: There is no legal matter here, only policy. Furthermore, the consumer protection laws and financial regulations are bought by BOA (and others) and so they can ensure that protecting me and my home from harassment, fraud, and financial damage on the part of BOA is expensive and fraught with corruption. They have fraudulently reported to the credit agencies that I have not paid my mortgage. I have to correct this with documentation from the bank every month. This costs time and money in supplies. They are calling, demanding I pay them funds I have already paid them. They are not permitting the early repayment of my mortgage, a violation of my mortgage contract. They are attempting to extort funds from me, threatening and causing me undue suffering and struggle, and costing me time and money.

Bank of America does not know what they are doing. In 2009, my spouse lost his job. We contacted Bank of America for assistance and they pretty much said so sorry, so sad. There was nothing they could do. I found an attorney that assisted with a home modification and Bank of America provided us with a 5 year plan. After 1 year, they took back the modification. I was paying as agreed but they said they could pull it back at any time so they did. They sent me foreclosure letter, because I was now behind the difference between what we had agreed and my regular payment. Bank of America representatives had no answers and moved forward with the foreclosure. My husband is back to work, and they are not willing to help. They don't want to lower the rate from 6.25 to the current rates of 3.75, which would help us keep our home. Bank of America would rather take our home back than assist. Never again will I get a loan with Bank of America or do any type of business with them. They are not very smart, if they are going to take my home which is upside down in value, versus trying to assist to allow me to keep it.

Countrywide gave me a bad loan at closing. BOA took over and offered me a modification. I had been in my home 12 years and never missed a payment. I’m a single white woman living alone, too. I got on board the modification ride because our president told the American people to take advantage of the modification process even if you are not in trouble but got a bad loan from Countrywide. Very long story short, I left my home last November after being run around for 16 months, put into default by BOA having me pay a different amount than what was really due.
They sent a letter via FedEx that I have in my possession to this day that arrived at my home in March of 2010, saying that I was approved for the modification and to keep my eyes out for my new loan documents. Day after day, week after week, then month after month I got the run around again. All of this nightmare started in July of 2009 to end in October of 2010 with BOA threatening me with foreclosure. Being single, with no family and no one to get advice from, I left the home because I refused to pay BOA another penny. The house had sat for one year before they actually did the foreclosure and repairing all the damage that had been done the past year it sitting empty. Again, I never missed a payment. I would still be in that home, modified loan or not, if I wouldn't have been lied and cheated.
I went bankrupt to begin a new life. I lost 12 years of investment. I lost security. I’m renting again at 47. I will never buy a home again. I don't ever plan to take a loan again. I will never trust a bank ever again unless they are held accountable for their corrupt and destructive practices. They are and have been and will continue to destroy the very core desire and goal of American citizens: the American dream of homeownership. It's dead.

BOA purchased my mortgage on my manufactured home from my original mortgage company, when they went out of business. They recently informed me they don't refinance loans on manufactured homes. Due to job changes and lower wage, I asked for a deferral for one month, and add it to the end of my mortgage. I was immediately referred to their foreclosure people! Folks on this site are absolutely right, pay up or we will take your home. So much for all the government plans to help people keep their homes. BOA chooses to ignore those plans, and make up their own rules. I am so glad my tax dollars bailed them out. I am now facing foreclosure, because I don't fit into any of their foreclosure prevention plans. I simply requested relief from one mortgage payment. I apparently do not qualify for any mortgage loan adjustments or compromise.

In 2002, I was approved for a mortgage loan with Countrywide, but did not know that I was in a balloon mortgage agreement, and I have been trying to get some of my money back from Countrywide, because I ended up losing my house, because my payments sky rocketed, to the point that I could not pay them. Also, at that time, Countrywide was supposed to be helping me and my late husband, with a modified package loan. They took 6 payments to help us with the modified loan, and turn around, and let our house go into foreclosure, and never got back in touch with me, or give me my 6 payments back. I have a cashier's check and a copy of my payments, but they still say they owe me nothing.
I have been writing them, calling them, faxing them copies of my papers, but nothing. Please check into this for me, because of all the stress of losing my house. We lost everything. Because of this, my husband got sick, and died from kidney failure. I lost all my savings, trying to keep up with these payments, and they still kept my money and my house. In August 2011, Bank of American sent a Home Modification application. We sent all the required documents on August 16, 2011. Several times Karen *** contacted us to inform us that the process was progressing. At no time did Ms *** indicate more documents were required. On September 28, 2011 Bank of America asked for copies of our bank statements, which were supplied to them on September 29, 2011 via fax. On October 16, 2011, Bank of America stated that they had never received our pay stubs (included in the original application). These were resent via fax to Bank of America on October 17, 2011. On October 27, 2011, we received a letter from a Cynthia ** informing us that we were in foreclosure.
I called Ms ** to inform her that we were current on our payments and were working with Ms ** on a home modification. Her response was, yes, you are current on your mortgage. She then stated she was our new representative working on our home modification and she would keep us abreast of the progress. On November 3, 2011, we received a new home modification application. I called Ms ***, who at first stated she did not have it. However, after a few minutes she located it and said she was sending it to underwriting.
I have called every week to inquire on the status of the home modification. Each phone call, I am informed that some document is missing. However, when I tell them the date it was sent, they seem to be able to locate it and send it off to underwriting. I believe that Bank of America has no intention of granting a home loan modification and are just waiting for us to default. In fact I was told the process would be quicker if I was in default. This is not good advice to the consumer.

Bank of America obtained our home loan from Countrywide. BofA called me and said they sent my house payment back because it was short $20. I was told to send them $1183.45. I sent them the amount on the 19th. The next day, we got a call saying we still owed them the money. I was told online banking aster and I needed to avoid a collection fee. I replied I sent the payment to them. The next day I got another call saying I owed them the money or I would have my credit reported. I told her I sent it in.
She looked at our account and said they should never have sent my payment back to me in the first place because they were receiving $2.00 over the amount so I never was delinquent! This is shady if they can hassle you when you are not behind! Now they have my overpayment, which you can bet they won't return and this is on my credit rating! Is this legal? Is this how they get properties away from owners? What recourse do I have? I have talked to four people and all had a different answer on fees house payment owed! This can't be the way home loans are governed, is it?

I have a current loan with Bank of America for my house in Maine. I have good credit in the mid 7's. I went to refinance to get a lower rate and they told me they would not refinance since it was a log home. How can I take advantage of lowering my payments when I cannot refinance through my current bank? This is typical of the big banks in America that were bailed out by the government. I have the income and credit to refinance and it is unfair that a consumer like me cannot refinance when a low-income person can. I would like to file a formal complaint.

I went to the bank to clarify my Nov 15, 2011 payment. When it was sent to the new mortgages company, the information was incorrect when my payment was made. I asked them to correct it. their response, "Just show your payment slip if anyone question it." The date that they have posted is Nov 22, 2011. That is my credit you are talking about. I made an in branch cash payment. I asked them to write a letter so I could clear this up with the new mortgage company, which is a terrible company. The Bank of America refused. The problem with the new mortgage company, M & T of New York, said they never receive my mortgage payment, which was sent out Dec. 10, 2011.
So I called them and made a payment on the telephone and told them the problem. They said the check must have been lost. I asked them, "If it came in, don't cash it." They agreed. They told me to make a stop payment on check. I went to the bank the next day and they already cashed it on Dec. 20, 2011. Now, they have two payments for Dec. and will not cancel one of the payments. My account is now overdrawn and they said they have nothing they can do. I have called three different times on that day with different department. Nothing! My other checks are not clearing. What type of company did Bank of America hook me up to? Merry Christmas, not this year.

I have been making my monthly payments as agreed in person with cashier’s checks. I discovered that BOA unilaterally compounded my escrow account for an unpaid property tax bill and never informed me. Therefore, they were able to report me as late payments and thereby hindering me from refinancing my home at a lower rate. I have spent last four months being told numerous solutions with each new representative inform me to do something different. I have now paid close to $43,000.00 in 2011 for an annual mortgage payment of approximately $32,000. Even with my property tax added of $6300.00, does this all just add up to truly predatory and unethical behavior?
I have over 42% equity in my home. BOA behaves in a manner with no accountability and increasing fees. I seriously have never witnessed a professional institution behave in such an unprofessional manner. Help! Is there someone that can hold them accountable? How do they get away with this type of practices and damage people’s good standing and just consume my time. Nothing has changed. They continue to charge me late fees and increase my monthly payments even though I have now exceeded agreed annual amounts.

Issue one - They charge huge fees for everything. If you want to make a payment over the phone, there’s a fee. If you want to make bi-weekly payments, there’s a fee. So, they charge you for paying your bill.
Issue Two - My wife was not on the mortgage and should have been. Her signatures are on all the documents along with mine. We had to go through a big ordeal to write a letter and fill out some forms to get her added to the account. One year later, she still has to go through a big ordeal every time she calls BOA because they do not see her name on the account.
Issue Three - We made a payment of $1173 and they sent us a check back because the amount we sent was $2.17 less than the full payment. They told us that they would not accept a check unless it was for the full amount. They do this so they can say that you have not been making your payment and can foreclose on people who are making an effort to pay for their home.

I have had the worst experience of my life since my house was dated as disaster area for Fema Program which has caused me to fall behind. I have filed papers for about 20 months with the same progress. The documents are constantly lost or misplaced. I need someone’s help as soon as possible. I wish I could give no stars because this company does not deserve it. After going into some financial trouble, I attempted to obtain a modification and that was delayed for several months. After the modification was made I still received notices that I was in foreclosure even though I was told by modification that the owed amount would be moved to the end of the mortgage. I still receive threats of foreclosure for that previous amount.
I have again fallen behind and began sending in bi-monthly payments to satisfy the amount owed. Recently I started receiving checks from BOA returning this amount after cashing my checks. All I am trying to do is keep up with my mortgage and satisfy what is owed yet this money is being returned to me. I have been told that the amounts are either over the monthly payment or under the payment. They want the entire sum past due at once, that the bank has no place to place the excess I pay. Doesn’t make sense. All I want to do is pay my mortgage and it’s returned to me. I usually get a foreclosure notice one week later which makes no sense either. I keep getting the excess amounts returned to me and the foreclosure notices one week later.

I'm a first time home buyer. I dint know what to expect well so I applied for a home loan. My credit was sent the best but they told me that this will not be a problem. I followed all of their guidelines and rules and proceeded to give them all my info. I first applied for this program called the platinum program where they asset you in a 3.5% of your closing cost well the sad news was that because of my credit score. I was not approved. I felt but Bank of America told me that they can still do the loan and that we will just have to due a FHA loan so we re-submit the paper work. This is where everything got hard.
A week later, almost meeting the dealing so I called in to see if I was approved or not. They told me they had to start the process over because they had a glitch in their system ''well that is not my fault'' so I had to request a extension my complain is that Bank Of America led me on in believing that they could get this going for me. I paid the appraisal fees and the deposit. I did all that was from my part! The asset manager of the home is telling me that I have to close by the 31st or I will lose the bid on the house and it will go to the 2nd person.

I applied for a loan through BOA for a home and told I was approved. What happened after was a total nightmare! I had to fax out numerous amounts of paperwork at least 10-12 different times. They then did the home inspection and didn't get back to me until 4-5 weeks later with numerous items to correct. It took me 2 times to get it right and one of the reasons was because of the bottom of a downspout was off!
Thinking all was well, BOA then asked for more and more paperwork and wanted to know why I had numerous deposits (which was from my job) and where the rest of the money went! The sad part of all of this, I had phone calls and emails go unanswered for days. The realator, the abstract company as well made many calls due to the fact that we needed to close on this house because of the sellers health! We then got an email from a Kimberlie stating that we will close on a Friday on a Wednesday! Well, 4 hours before closing, they denied the loan because they couldn't get positive payment info from a prior mortgage I had with GMAC on a home that sold almost 3 years ago!
I explained to them prior to this that my ex wife filed a bankruptcy in 2006 and I never knew that this affected me as well since her name was on the mortgage and it was never reaffirmed. I found this out from 1 phone call to GMAC. It took BOA 3 weeks to get back to me on this! They did tell me that I could use my landlords letter showing that I lived in his home and rented for the past 3 years which I did stating from the landlord that all payments where on time! They still then turned me down right before the closing and wasted almost 3 months of my time. Sadly the seller passed away that day as well.
A good came out of a bad though. My neighbor lent me the remaining balance and I did purchase the home! My local bank and 2 local mortgage companies could not believe what I went through with a 711 credit score! Please tell everybody not to use Band of America. Nobody should ever go through the BS that I went through!

BofA lied by telling me that they were working on a loan modification while they were foreclosing on my property. Even 2 months after foreclosing they continue mailing me letter with a rep. name. Why don't we have a class action suit yet in Virginia? It is revolting how this bank acts and continues to act; they have absolutely no regard for the people they continue putting out in the street. Like another person here, 1 star is too high for BOA. After almost 3 years of fighting for a modification, and errors after error, and sending in the same documentations time after time, I was finally told on Thursday that I was approved. Of course, surprise surprise, they needed 1 more piece of info to complete the package for me, which I supplied. During that period of communication with them, which lasted about a week, their attorneys sent my house for foreclosure sale! I am now waiting to be told to get out.

No rating required, just some very unpleasant past experiences and now a fear that I am about to join the many others who have shared on this site. I'm trying to formally document the process in which I am about to engage. I'm trying to effect a "deed in lieu" on a rental property that is "upside down". The payments are up-to-date, the property is in fair condition, but in need of about $10,000 worth of work. Taxes are paid current.
The BofA has been notified twice by phone and they tell me no written notice is required and that someone will be in touch with me in about 10 days. They want a long list of documentation: Tax records, pay stubs, income analysis, hardship letter and name of lawyer. I'll keep you posted.

It is almost 4 years since I had my mortgage with Bank of America. I had never been late because the payment is automatic debit. I have repeatedly responded to mail from them about lowering my payments to no avail. I am currently on a fixed income and filed the paper work for modification with all requested information. Shortly thereafter, I received a second envelope requesting the same documents. I collected and sent them a second time. On Dec. 14th I received another packet asking for the same documents again. I will not provide them a third time. Since I bank with BOA, it gives them access to all the information they need.

BofA is a servicer on some loans, but they will present documents to the court to pursue foreclosure. Only the legal note holder can pursue legal actions. Lots of the loans were illegally converted into stock certificates. This conversion in essence voids/cancels the promissory note and makes the loan an unsecured debt. Request the "wet ink" documents; this is what you signed with blue ink. BofA and the FC attorneys are committing land record fraud, security fraud, extortion and violating many RICO laws. When you get foreclosure notice it will say BofA acting as trustee for the investors and an asset back security. The security will have the year and a series of numbers which identify the security that was registered with the SEC. Go to SEC’s website and get the prospectus with the PSA (aka Pooling Security Agreements).
This also reveals to the investors the risks involved with this investment. My loan was converted into a pool consisting of 5,000 loans with a total value of $840 million. This is why BofA refuses to modify loans because it will devalue the stock. Also in the prospectus, a diagram will be presented on the cash flow direction and relationships between the originator, sponsor, BofA, investors, etc. This is a Ponzi scheme formulated by "superior” knowledge Wall Street financiers which was never meant for general public knowledge.
All said, BofA is not the legal note holder. The investors are, but they hold a stock certificate. Refer to "double dipping" violation. Anything you see with quotations (“ “) is a legal term. Look it up and educate yourself. Remember when a loan is properly transferred or sold, the promissory note needs a valid security deed filed also (state law in all 50 states). If the title chain is broken, it will be shown in a title search. BofA claims to be the rightful loan holder and title then BofA's name should be listed. Also, for your information, if you previously got a mod and all past due interest payments were added to the new loan, the interest added into the new loan is mort interest that is deductible under IRS regulations, which of course BofA refused to issue the 1098's. I just won my case with IRS regarding an audit involving mort interest paid. The IRS agrees that BofA failed to do their fiduciary responsibility to the homeowner and IRS inquiry is being done at the present time at my request.
BofA purposely delays, displaces, hang up, etc., in order not to deal with the homeowners. I experienced all the situations discussed by others. I filed law suit against BofA. It’s pending and will go to Federal Court on January 19, 2012. I can't wait to present all my evidence with violations noted. It’s time to castrate the bull/bully. BofA should change their logo to BUFU (** **). Their might makes right mentality needs to change. File suit, join in mass. Join and do something.

I emailed requesting info on available mortgage principal reduction programs. The reply said to call. I tried for a week to get hold of someone. I filed a complaint with Better Business Bureau. I received call from Jamila on 12-6. The call lasted 16 minutes. I was told I don't qualify for any programs. According to the FHA website, I qualify for several. I took a recent pay cut at work and am trying to avoid becoming delinquent and/or losing my house and they've been completely unhelpful. I appear to be eligible for all of the following programs: MHA, FHA Short Refi, HARP, PRA & Hardest Hit Program, yet I was flat out lied to by Bank of America when they told me that I need to be experiencing a hardship due to death, disablement or divorce and/or be more than 61 days delinquent. Clearly, they are unwilling to help and want to take my house.

I began to look for blogs or sites, through which, I can lodge my complaint against this bank's obvious disregard to the needs of their customers, and the less than mediocre customer service we've received on a VA backed home mortgage application started way back 9-24-11. I swear I was feeling like the Lone Ranger, as we've been stuck in a perpetual, hellish paper loop, lack of return calls, between us and BOA mortgage and underwriting for more than 60 days! However, after reading my story (and worse) re-told on this site time and again, I am convinced that a simple blog will not have the impact I am looking for, and I didn't want to bore readers on this site with the same song, different dance.
What's embarrassingly funny about all this, is that I am a Realtor, with experience in closing processes. I was warned by colleagues prior to making our application with BOA, but felt since I have been a BOA customer since age 13 (am now 54), and they've had our first mortgage for the past 15 years, that they knew us, and there would be fewer hoops to jump through. Boy, was I in for a shock!
I would like to suggest that we organize and do an "occupy BOA" nationwide at every BOA branch and affiliated company office in the US, to get the press and the attention we deserve. I teach customer service, and have repeatedly warned my corporate clients, that with the power of the internet, their failure to attend to their customers could have irreparable effect to the bottom line. I am ready to practice what I preach!
At this point they have my ** in a vice! We have leased our old home, and are currently leasing the home we have been trying to buy, but due to their incompetence, the experience of amended contract after amended contract, and thanks to your posts, I now realize that I need to see if I can renegotiate this, and find another funding source. I had read that a few of you would be willing to consider a class action suit. I am open to any suggestion, but I feel a boycott impacting the value of their trading shares, is the best bet to getting things changed! I am willing to lead the charge, but I am a bit of a techno-nitwit, and unsure how to best organize. Is anybody with me?

I worked for Coldwell Banker in Ridgecrest California. The broker/owner is Kathleen **. Agents falsely bill banks, claims that work is done to property, but in fact is not. If you audit her, you will find that all her invoices are written on the same day, all the work is done on the same day, and if you go by the homes first that she currently has, you will see they are not clean. I have notified my supervisors, and I was recently told not to worry about it, and that it is fine. I recently left that job, because I do not want to be part of false billing, and/or whatever else that company is doing.

I have a house in Texas which I am trying to sell for which I have two loans through BOA. After it being on the market for a couple of months, I received an offer and agreed on terms and everything was set to close on December 9. The title company requested the payoff amount from BOA on 11/23 which were never received. After contacting BOA several times, I was told I would have the payoff amount sent. The date, 12\9, came and gone with no payoff, just empty promises. I was able to move the closing one time but BOA still did not provide the payoff amount. Now the new lender and buyer are no longer willing to wait and it has cost me the sell of my home.
So not only have I lost the sell on my house, it has cost me several thousands of dollars because of this already. Io top it off, the potential buyer is holding me responsible. Not to mention the poor buyer without anywhere to live because of this, does the average American like me not have any protection against giants like Bank of America? They seem to have all the power to do whatever they want.

I am currently living and working overseas. Renters are living in my house and my mortgage is paid through automatically each month through my bank (not B of A). In Sept my mortgage adjusted slightly ($80 more). Since I don't live in the country my mail goes to a PO Box and is then forwarded so it takes about 1-2 months to get mail. My Sept mortgage and Oct mortgage were paid automatically at the same amount that had been paid every month for the past 3 years. I didn't find out about the rate increase until I received my mail in Nov which was full of late notices and loan modification applications. I called customer service and was transferred multiple times (hung up on). One agent told me my house was in foreclosure since it was 2 months past due (even though I paid both months and had documentation from my bank) and started reading me my foreclosure rights. I was finally transferred to someone who seemed to understand what was happening and was told that since my mortgage had increased $80/month my regular payment was short so the amount was held and not applied to my account.
They then took the money out of the holding pattern and mailed a check back to my post office box where it would then need to be mailed overseas so I could sign it then mail it back to my bank to re-deposit it and finally resubmit to BofA. I was told that instead of this they could stop payment on the check and apply it to my mortgage in 5-7 days. During this time my mother started receiving 5-10 collections calls per day. I called back in 7 days to check on the progress and was told that it the stop payment hadn't even started. I then waited another 7 days (during which my mother was harassed by collections calls and my credit score continued to be destroyed). Finally on Nov 29th they were able to apply the Sept and Oct payments to the correct locations but I was then told that there had been an error in processing my Nov payment and it would be returned to my bank and need to be sent to BofA again! I asked the customer service person if they could stop the multiple collections calls to my mother and was told that she should "just not answer her phone" (5-10 calls/day).

Like some of the other complaints, I have been in the loan modification process for over a year, having completed my 3 month trial period successfully quite some time ago. Just a few days ago when I called about the status, I was told "there has been a serious delay in that department". I was not able to get any additional information. Now, as I begin to do a little research, I see that BofA is in numerous legal battles - including several related to their poor implementation of loan modifications. That’s one horror story after another. What’s next?

One star is too high to rate our experience with BOA! On June 1, 2011, my husband and I applied to BOA for a refinancing of our home loan. Our goal was to reduce the 'total' amount of interest we would pay until we pay off the house, by reducing the interest rate and the capital as well. (We were ready to push a substantial amount of cash to reduce the principal borrowed.)
The amount of money we were asking for, was less than 25% of the appraisal of the house (appraisal performed by the BOA itself. ) Our household annual income is more than the requested amount, our jobs permanent, and our credit score excellent. I am not even going to talk about the amount of documentation they requested in the process. It was ridiculous!
Our main complaint is that it took exactly 6 months for this closing to happen (Dec 12, 2011)! During this period we were on continuous contact would be assured that "the closing is just a matter of days".
At some point one competent employee took over the case, started everything from the beginning again (appraisal, title search, etc) since everything had expired so long after, and had the case done in 3 weeks. I won't talk about the amount of documentation

I have looked into modifying my loan with Bank of America and it's so hard to deal with these people. First, they want all these forms filled and filled with so much detailed information and tons of copies of everything as if the modification was going to be made. Then they call with to say the modification was not approved because of something and I would say "I told you my situation, you could have told me that I did not have a chance because of whatever" but the people you deal with are so lame that there are layers and layers of ** that have no idea what they are doing.
I am behind 4 payments due to a hardship, but I am making my payments and I asked if I could send additional amounts over my normal payments to makeup/catch up my past due payments. They said I would have to pay double for four months, anything less than the double amount but over my regular payment would be returned to me. That it has to be double the normal payment. I said what? I go, can you send me this in writing, like a schedule of payments? He said "no". That sounded weird as if they were hiding something.
They said that since I did not qualify for the first type of modification, I need to resubmit everything all over again to somewhere else. I said, but you have my application! Why don't you just forward it to the next step and his response was negative, that is the way it works. I hate Bank of America. Another thing, I had to be the one calling for to figure out the next step, they don't send you in writing what to do next.

On 12/30/10, I cancelled my escrow impound account,and received a check refund of the account balance on 1/3/11, followed by an updated payment statement for my new payment amount. I pay my bill via online transfer, on the 7th of each month, and have never been late or missed a payment. In mid-March, I started receiving "robocalls" from "America Home Loans", and after filing an FTC complaint, I called the number to try to get the calls to stop. The calls were actually from BofA's bill collector, who told me I had a balance due. I learned that BofA had withdrawn $819, and sent it to my insurance company, despite my having closed the escrow impound account, and them never receiving a bill.
BofA then turned my account over to collections. I made a bunch of calls to identify BofA's error, replaced the funds that BofA had illegally withdrawn from my account, and got a refund from my insurance company for the extra payment. I then wrote a RESPA QRW to BofA, demanding they close the escrow account (again), correct any additional errors, remove any late charges, and ensure that my credit was not impacted by their mistake. They ignored that RESPA QRW, as well as two additional QRWs, sending acknowledgement letters, but never making any attempt to correct their errors. They never actually fixed the mistake, but instead, kept adding late fees to the account, and not properly crediting my monthly payments.
Every time I reached an agent, the person tried to fix the problem but the fix was undone by the next day. This went on for five months, when they began sending checks to me for "partial payment", because after withdrawing the late fees, they kept adding for their mistakes. My mortgage payment didn't cover the full P&I. I spent more than 45 hours trying to reach someone, who would help fix the problem, and got many promises, but I could never get anyone who cared enough to follow through to resolve the problem.
I finally was on the verge of hiring a lawyer when I made 1 last attempt. I emailed the BofA CEO, and included a copy of my notes, describing all of my actions to try to fix their error. At that point, I received a call from someone in the CEO's office who fixed the problem. After all of my time spent, and months of stress trying to avoid a foreclosure action, BofA never even sent an apology. Only a $25 gift card for Home Depot.
I tried to refinance my property during the summer but BofA had reported something negative on my credit report so I was unable to qualify. (my credit score is normally around 800). The value of my property has since declined, and the loan to value is now too high to refinance, without bringing a significant amount of cash to the transaction. I spent more than 45 hours of my time trying to fix their error. This time was spent during my work day, so I had to make up for these work hours. I developed stress related health issues, and had to get acupuncture treatment, because massage therapy didn't fix the problems.
I paid my bills on time, in full, but was totally abused by this company. They were obviously proceeding down their foreclosure track with my mortgage despite the problem being 100% their error. They illegally withdrew money from my account, violated numerous regulations, and thumbed their nose at RESPA, which is supposed to provide the consumer with some protections. I want some consequences for BofA! I have copies of all documentation and notes on all of my calls, and conversations. Is anyone suing these **? I would love to lead a class action lawsuit, so they have to pay punitive damages for all the people they have abused.

I had posted here several months ago, about my family's situation with BOA. The tune of this board is negative, as we've all had so much trouble and headaches with BOA. However, I want to share a piece of good news, and offer hope to those out there also in my situation.
After 2 years of waiting on BOA to help us modify our mortgage (and not making a mortgage payment in those two years) We finally heard from BOA, telling us they are going to approve us for a trial modification from Jan-March 2012. This is after we were denied several times before by both MHA and BOA in house department. They lowered our original payment to $100, and told us if we could make those payments on time for three months, they would consider us for a permanent modification. I understand and realize there have been many who have not had success with this particular arrangement, but I truly do believe this is the answer to our prayers, and I know we are going to be able to keep our home.
They told us they have no intention of foreclosing, and this is apparent in the fact that we've not made a payment for 2 years, and we are only considered delinquent. They explained once we're approved for the permanent modification, they will take the arrears and capitalize them back into our loan. We realize we may not have much equity in our home, but we are already upside down by no fault of ours, just the way of the economy. We're hopeful we can stay for several more years to come, as my husband is filing bankruptcy, and he needs the time to improve his credit.
Everyone fight! I fought for my home. I was relentless. I wrote two letters to the CEO and Barbara Deseor, V.P. of Mortgage Services. I was heard, and I was answered quickly after that. Before that, I made so many phone calls, and was always persistent week after week, to pester and harass BOA. They were tired of hearing from me. Of course, I, and many others prayed without ceasing as well. I believe in prayers, and I believe in fighting for something worth keeping. I encourage you all to do the same. They called my house over 20 times without leaving a message and when I answered, no one said anything. Then, they called my job and did the same thing. I called them and was told that they had not received payment in 60 days then proceeded to acknowledge all payments. I made two months of payments without ever receiving a statement. No statements showed late payments, extra payments due, etc.
When I received a statement showing escrow, I paid it all as I was told that if I did, my monthly payment would remain the same. The next statement showed four times more escrow due and my payment went up $70 a month with no explanation. I have always paid on time. I feel that they have some responsibility in explaining or proving non-payment which I have no record of.
How could I be 60 days late when they acknowledged payments? How far back are they talking about before starting the calls and why call if no one says anything? Why not speak or mail me a list of payments? How did my escrow go from approximately $190 to over $500 on the very next statement? My payment has never gone up more than $10 since I have been living here (1999) and that's when times were good. Taxes and insurance have gone down, so why did my payment go up $70? Why is there no customer service? I wish they would sell my mortgage to another financial institution.

Bank Of america mortgage. One star is too much to rate boa! We started out with a loan of $159.00. Now it is $204.500. We have been fighting with BOA for a year now with a lawyer for this modification. Our house has been up for sale 5 times and it has been stopped. But the bad things is you get a modification then they take you off and say I requested it. I did not. We made our payments with the last modification and they never applied it. They put it in parc. bal. Then added late fees. I will never pay. I have print outs from BOA website account of my payments. One payment, it took them a month to cash the check.
We then send certified checks with return receipt. So I would have a name who signed and when they got it. I called and they said we do not have it that is why the late fee is applied. I would tell them I have a return receipt and give the name of the person that signed and when it was received. It did not matter. My lawyer has sent 2 demand letters to them to give proof that we owe them money, they cannot produce the papers. I tell you this, if anyone sue's them let me know, my husband and I will be right there. All they have put us and others through is sad and they need to be stopped. I could go on and on but it would take all day and night. I have a file that is about 6 inches thick of papers that i have filed sent, copied, noted and faxed. If there is anyone that can help let me know.

Bank of America serviced my mortgage for almost eight years until they sold it to another bank. They sent me a statement stating that I was to pay mortgage to the new bank on November 1, 2011. I submitted a claim to my homeowners insurance last month and got a check payable to me and Bank of America. Today, I went to the bank to deposit the check and they refused to process my request since my mortgage loan is no longer with them and told me that I was responsible for making all the necessary changes for escrow payments. I called my new Mortgage bank and there are no locations in my state. I feel very upset and will cancel all my accounts with Bank of America.

I am waiting for a response from Bank of America regarding a loan modification qualification that was to be reviewed this past Tuesday. I haven't heard from Bank of America yet but I did receive a yellow post on my door today indicating that Fannie Mae (Mac) has taken over my house. I've been trying to modify the loan but in all three attempts, nothing favorable. The first time, I was declined because according to the bank, I didn't submit all paperwork. My house was scheduled to be sold at the court this past Tuesday but my case manager said that they will review the documents submitted this same past Tuesday. What happened? I don't get an answer from the bank yet I get a notice on my door where I can easily see that I lost my home. What can I do? Where do I turn for help? I called the case manager and left her a brief message. I'm waiting for a response. Lets me think, "What excuse they are going to give me this time?"

The first time I tried to submit, it said I had to rate my experience. I didn't the first time because I thought one star was too high. Since I had to rate, one star is the lowest, but still too high. I too have had the same nightmare experience with the Bank Of America modification process. Every packet returned filled out completely and on time, every daily phone call answered and addressed, everything BOA asked me to do, I did. During this time I also made many duplicate mailings, faxes and phone calls due to BOA stating that they either did not receive the fax, have any record of me calling or show no record of receiving my documents. I have even made the supposedly 3-month trial payment on time for over a year, only to find out that I had to re-apply.
I then made the regular loan payment on time for 10 additional months. I was then told that I did not qualify and it was best that I initiated a short sale. I did. There was a cash offer that was declined! Not countered with an additional higher amount, just declined. The next day, there was a note on my door stating that the property had been purchased at a trustee's sale and a realtor had been hired to sell the property. This happened within a couple of days after they convinced me I should initiate a short sale. I am still receiving letters that my loan is under review for modification and that someone will be contacting me within 20 days. When I asked about these letters, I was told that BOA has no record of these letters being sent.
I was told I needed to vacate the property. I don't want to. My 6-year-old will be devastated. I have jumped through hoops trying to stay in my home. Also, this is the first time since I got the loan in 1995 that I have had repayment issues. I feel I along with everyone else has been given false hopes all while jumping through repeated massive paperwork requests.

I have the same complaint as Desirai of Lincoln, CA. Two calls a day letting me know my mortgage is in arrears. I have paid my mortgage on the 15th for 12 years. When I went into my local branch in Mechanicsville, MD to try and get the calls to stop there was nothing they could do. This was the first they had heard of this and seemed as surprised as I was to learn that any payment after the 1st is past due. They don’t charge us until after the 15th as a courtesy. I’m going to shop for a new mortgage tomorrow. I have lost my trust and don't feel safe with BoA holding my mortgage.

I've been trying to get my mortgage remodified for over six months now. I've sent all the information they ask for, then they say it's too old, and ask for the same information again. I've told them my income has been frozen for two years, but they still ask for my income information, my bank information and my bill information over and over. I'm fed up, but am still trying to pay even though I am getting further and further behind on my other bills. Bad credit is the least of my worries. I'm afraid that I finally will get so far behind that I won't be able to pay my home mortgage and will lose it.

My husband and I have been in the process of refinancing our home loan. Bank of America has our current loan. We have been early on every payment! This process has been awful, continuously requesting information they already have, or have access to themselves. We have done everything they have asked. Now, they are telling us they can't make our 60 day lock. We have been strapped, not using our credit card for the holidays, planned on skipping a month's mortgage and putting it towards Christmas. Now this? We are ready to move on from this bank! If you cannot close before our deadline, we're done with this bank. My husband is going to the news.

Little did I know that when BofA bought the rights to manage my FHA loan 3 years ago that I would be in living hell! I have been dealing with ridiculousness when it comes to paying my mortgage to this bank, BofA. But the latest and newest complaint is for harassment. Payments are due on the first of the month. There is a late penalty after the 15th and they don't report you until you’re 45 days late; but that doesn't stop them from calling because technically you’re late after the first and it’s an attempt to collect a debt, a courtesy!
They know how to call. I receive calls every day, sometimes every hour of that day. And no matter what I tell them, they call again. Calling me only makes me hesitate to call and defiantly makes me despise this bank more and more. I have spent my time, money and so much energy into keeping my mortgage with BofA and have never received customer service from them about my ongoing issues. I just want to be rid of BofA!

Bank of America used the tax payer money for their benefit and then turned foreclosure type loans to their sister to make more money. Bank of America is now running a foreclosure business. I guess foreclosure looks bad on the bank especially since they have taxpayer’s money to help the public. And they use Green Tree who they can push their problems to. I do not want to foreclose. I want to keep my property and refinance. But Bank of America labeled it as a bad loan and sent it to their sister company Green Tree for further investment from the poor. Bank of America does not want to tell you that this is part of their company. But I know how they’re trying to make money out of everyone who is already in trouble due to the property values.
Green Tree is a company from hell. They have rude staff and even worst supervisors. They have taken over 2 months to go through a subordination process for me. Bank of America likes to sell loans to them and avoid foreclosure on their books due to the taxpayer money they received from our government to help the people.
Bank of America sells these loans and do not send out any communication. I had to find out afterwards when I went to make my payment. Green Tree holds on to the loan until they can come and take over your house since it is part of their plan. They make the refinancing process almost impossible. My new lender is ready to close on my loan but Green Tree wants to drag the process for months. So, my new lender walked away and I am stuck with them again. That’s part of their money making machine for Bank of America after forced foreclosure.
My lender complained about them and no one is doing anything to fix it. I worked with Erica ** who is the subordination staff and her supervisor Stephanie ** who is no help. Stephanie is worse than Erica. Erica tries to be polite after I ensured her that my frustration is at the process and not her. During the first few times, Erica put me on hold for 15 minutes after I complained. I called back and got someone else but it was the same process. I feel the subordination department is run by one person. And there’s no Erica and Stephanie. There is no one to complain to in Green Tree to get anything done. Actually, nothing gets done until they come and take over your house to make more money.

Nania ** works for the mortgage modification unit. She has continually asked me to resend faxes that I sent and have receipts for. She told me that when they receive a fax, it may take days for it to be put on her computer. Then, she will tell me it never arrived and we were denied because we didn't send the required papers to her. She is a liar and Bank of America is stealing the money the government set aside to help mortgage holders refinance at a better rate. When a class action law suit starts on this fraudulent bank action, I want Nania ** included for lying and fraud. Our income in under $22,000 yr and my payment to BOA is $800 per month. We are dying here and Boa don't give a **.

BOA pre-qualified me for a loan on a second home (retirement) I was requested by phone to pay a $465 fee prior to receiving the loan package and was told that if the loan was denied by BOA, I would receive a refund of the fee. After months of faxing documents, they denied the loan because I was unable to document where a $300 deposit to my checking account came from. This deposit was made 4 months prior to the loan application. BOA has refused to refund the $465. I understand this is a small amount, however, if you multiply this amount by hundreds and thousands of fees, you can see that it adds up pretty quickly. BOA is running a fee scam. They also tried to pressure me into a credit card and life insurance. I do have all the documents available as proof of my claims.
