We had hail damage to the roof of our residence and contacted our insurance company. Travelers Insurance was extremely responsive, came right out, inspected and verified the damage and issued us a check in the amount they estimated to replace the roof. Because we have a mortgage with HSBC, the check was also issued in their name. They sent out a packet of documents needing to be completed by us and the roofer. We sent them in and then it was delay after delay after delay with HSBC. I kept being told they needed another document and I would get that in and was told it looked like everything was correct and the check should be mailed in 3-5 business days.
I would check back and would be told then another document was missing and would take another 3-5 business days. Well, this went on for weeks until finally, the roofer got scared off, thinking the same would happen with the check for final payment for them. He disappeared and then I had to find another roofer and start the process all over again and now I am completing month one of the same nonsense and in danger of losing contractor number 2. I need help. Please.

I have pretty much the same story as most of the others. My husband had lost his job. HSBC did give us a temporary "hardship". I believe it was 3 months. My husband was out of work for 1 1/2 years. Just prior to my husband losing his job, we went to a Beneficial/HSBC branch and refinanced a 20-year loan and so the payment was pretty high. And of course, when you go to sign, they jack up the interest rate upon signing for whatever lame excuse. Anyways long story short, HSBC would rather me give up my house and sell it for half of what we owe, than take the time to refinance the loan to a 30-year and maybe lower the interest rate a little! I lived in my home for 21 years! Thanks HSBC!

I did not sign any documents prior to closing cost. HSBC and the broker processing the application was fraud. They forged my signature and this is the reason why HSBC did not process the loan application prior to the closing cost on July 26, 2006. I was a victim of HSBC's mortgage fraud, forgery and predatory lending transactions prior and during the closing cost.

Due to a lot of unforeseen medical bills, I was having trouble making ends meet. I contacted HSBC on numerous (way too many too count), to try to work something out with them. Refinance, modification, anything. Everything I tried was against their policy. I received letters concerning matters I never spoke to them about, saying I applied for this and that and at this time there is no help for me. On three occasions, their representative told me to contact HUD. I did.
HUD came back with the fact that there was no help available for me, not knowing that they had to contact HSBC and see if they were willing to work with them. On more than one occasion, I was told by the representative at the other end of the line that they owned my property until it was paid for and reminded me that I did file for bankruptcy which should have been enough help and here I am asking for more. If I could not make the payments, turn the property back over to them.
I explained that the $3500 deductible I had on my health insurance was keeping me stretched to the limits. I proved that to them. On more than one occasion, I had to send bank statements, copy of medical bills, explanation of what I was diagnosed with, a list of medications, required prescription and over the counter, my pay stubs, all bills related to the house. And every time, I was told, "sorry, we have done all we can do for you." In October of 2011, their representative informed me again to just make the payments or leave; they will come secure the property.
So after 18 months, I left. They secured the property. Now, again, they are refusing to do anything. It is against their policy to foreclose. "No, you cannot just turn the property back over to us; that is against our policy. We are not taking any properties back." I asked them how long it will be till they do something because now the homeowner's insurance has been dropped. They found out the property is empty and they will not insure an empty house and I cannot find anyone to pick it up.
HSBC is telling me it will be 2 years or longer until they make a decision, "No, do not send us your keys to the property. We will not accept them," and oh, yeah, "you are aware that the debt forgiveness clause runs out in 2012". There you go. This is a legal way of stealing. I feel that was their intent all along. Am I going to an attorney again? Oh, yea.

Our mortgage was sold to HSBC and since that day, we have been in a living hell. The company lies. They deliberately post payments late. Now we owe more than we borrowed! We call them and they act like they don't know what we are talking about. They give us different departments. No one ever knows anything about our situation even though we have called and they mail us letters. They still say they don't know what we're talking about. They refuse to give us a modification when everyone else in the country is getting one! My husband's entire industry has been demolished by this great recession which is not our fault. They lied and promised and misled. It is unbelievable that a company can operate like this in America! They are deliberately withholding info in a criminal investigation! I contacted my state representative who passed on my complaint to the OCC. I haven't heard a word! I do not have enough room to describe what my life has become as a slave on the HSBC plantation. Somebody, please help me!

In 2004, we paid off a second mortgage with HFC. We lost our first home to fire. So we sold the property and decided to buy elsewhere. I've always said that I would not do business with HFC again. Now, we buy another home (my wife being the primary on the loan). Our mortgage was sold to another mortgage company. Six months in, we received a letter stating that our mortgage was being purchased by HSBC, which is the parent company. HSBC is Household Finance Corporation, a known predatory lender.
The attorney general in 1999 filed a lawsuit on Household Finance Corporation. The state won the lawsuit, though we could not get in on said lawsuit because we started our account in 1997. They only went back one year. So those that were really hurt by this practice were not able to join said lawsuit. So, now that Household Finance already had our info from past accounts, they illegally pursued us with the mortgage we have now. We are not getting any help from HSBC at all. Will someone please check into the practices of HSBC and Household Finance Corporation? Thank you.

I requested my loan documents from HFC. They are charging me 12.24%. At the time of signing, I signed for 8.75%. HFC page 1 which I never saw attached to two more pages showing my signature with no interest mentioned on page 2 or 3. The original page 1 was changed to reflect their security agreement. Not the original page given to me at signing. I was told at signing I would be provided with a new copy. Well, I did not know about predatory lending practices, bait and switch approach. I also have a penalty for prepayment. What I was also told when I questioned back in 2004 was that that was simple interest and is not charged in advance. I have paid over $26,000 and still owe over $27,000 on the loan which originated at a principle of $29,745. There should be a law. They will not refinance, only give temporary six months lower interest if you qualify, which I did once after Hurricane Katrina, and now. There should be laws to minimize the amount of interests charged. This should be illegal. Can't some attorney bust their chops? Where is the President? This is what he is trying to prevent. Bush sure made it easy on the good old boys.

MERS fraudulent foreclosure: I am in Colorado and had been struggling to get Litton to work with me on a HAMP. When Ocwen was granted permission to acquire them, Litton lost paperwork and spread my file out over to a "new contact person" each month or less. Several documented yet separate attorneys/firms claiming to represent either Litton or HSBC MERS were contacting me. HSBC filed the notice for foreclosure to begin on May 3, 2011, which was the day before the written due date that Litton, the only company other than Litton's "bankruptcy attorney" and Fremont we had ever dealt with, had given me (May 4, 2011). Litton received my initial completed HAMP package on May 4, 2011 and assured me no foreclosure action would proceed and that in fact, "it would be withdrawn."
Litton continued to request additional copies of the same information, until finally, they denied me based on NPV, stating the home's not worth the loan amount. This denial was dated September 26, 2011. The envelope it was in was dated October 3, 2011; and it was delivered on October 12, 2011. My request for a re-evaluation was ignored, as was my QWR for a detailed accounting of funds and how these funds were used and applied. At that time, HSBC had a foreclosure date in effect for November 7, 2011. The HOPE councilor had escalated our case in late Summer 2011. They were told by Litton that Litton would assist us with a HAMP. During November and December 2011, Litton became Ocwen; and Ocwen had none of my HAMP paperwork or my NPV revalue request. And they still have none of it. Ocwen stated simply that the HAMP was denied but "cannot" say why and "are not allowed" to tell us who our lender is and that the property "is now REO as of February 15, 2012."
The foreclosure process was not stopped or reviewed during the changeover to Ocwen. In fact, it seems it was accelerated. This home loan was gone into with Fremont Investment and Loan in February 2005, when they refinanced my then existing 2-year balloon mortgage from Pinnacle Mtg Grp of Littleton, Colorado into 2 loans. The 1st was on an ARM with a low teaser rate for 110 percent of value to cover well over $12k in broker and bank origination fees, and so we would "have no out-of-pocket costs." My documents show recognized robo signatures, such as Denise **, an employee of Litton signing as VP of Mers, as well as "certified copies of the originals" later replaced with a copy of a document with many blank and standalone signature pages. HSBC's alleged proof of transfer from "Fremont, which address is Litton Loan Servicing," under a "Pooling and Servicing Agreement dated July 2005" is a single signature line on a blank sheet of un-numbered paper with two asterisks and a blank line as designation. This was recorded in 2008, and we have never seen a "Pooling and Servicing Agreement."
The Fannie Mae loan that Fremont had put us in "to accommodate a fixed interest rate" in October 2007 has never shown up on the FM website. Later is mentioned CITGroup/HSBC Trust for Fremont. MERS is multiple roles, including Trustee for HSBC/CITGroup Trust for Fremont. MERS is signing this "note" over to itself and is also performing in Colorado prior to their SEC licensing in Colorado. It's fraud, fee abuses, and payment pyramiding. In 2007 and 2008, we were told we had to be late before they would help first by Fremont then by Litton. HSBC initially filed for foreclosure using a certified copy of the original note and never came up with blue ink, even though we requested the court to produce the documents. All of our pleadings were ignored, not dismissed, but completely ignored as was the evidence submitted. It's not even placed into record, though it cost over $200 just to file them with the court.
In late 2007 and 2008, Fremont denied ever owning our or any mortgage; and Litton told us that Wells Fargo owned it, eventually claiming HSBC who has proceeded with foreclosure sale on a completely burned and destroyed home in order to repurchase it for $310k after making a $280k claim in my Ch13 (for 2 years, during which time they did receive payment) turned Ch7 Bankruptcy. In October 2008, Litton put us on a reinstatement plan just as our Chapter 13 bankruptcy began; and my husband had to go to Iraq to work for a DoD contractor in order to attain a decent wage. Litton's reinstatement monthly payment was $4500 per month for 10 months, then they were going to modify my loan and rebate fees and interest. We were barely able to make the payments and only because my husband was working for war zone uplift pay on a short-term contract, but we were never modified.
On November 3, 2011, my home burned to the ground, ruled positively accidental, and we lost everything. My self, my husband, our 16- and 21-year-old children, and my daughter's fiance all lived in the home. We were left with the clothes we escaped in. On February 15, 2012, HSBC sold my home at foreclosure to themselves for $310000, an amount over $50000 more than the stated loan original amount and $50000 more than the value of a burnt down danger zone of a home that the insurance company, though paid, has not even begun to assist in demolishing or site clean up and have put us through over 8 hours each of EUO (at $250/hr, which meant we had to take a personal loan and the only one we qualify for with all this looks like a $10k payday loan).
HSBC is not listed as the lien holder; Litton is. And Fremont is the last known note holder via a Fannie Mae modification in October 2007 that wasn't recorded. But I have the papers; these documents include the originals down to the deed with the county sticker. They were in an area we were able to get to rescue them after the fire. The insurance was paid from our escrow in December 2011 by Litton covering the dwelling and contents through January 2013, though a recent letter informs me that Kemper will be canceling the policy as we have "no interest in the property" any longer. Litton cannot be reached online or on the phone, and Ocwen has no idea whom to put me in contact with and in fact, disconnects the call on me any time questions can't be answered by them.

I had a hail damage claim on my roof and HSBC is the mortgage company. Note: I own a roofing company and all my work is through insurance companies. First, the total claim was under $10,000 which with all other mortgage companies means that once the work has been completed and the insurance company has sent in the depreciation check, the mortgage company will just endorse the check and send it back to you. Even though I've sent in all the paperwork for the completion of work done, HSBC wants to pay 30/30/30. This sort of payment is done on a large job, not on a job that took one day to complete and now taking months to receive the final check. Even though I've sent in the total worksheet (work to be done to repair damage paid for by the insurance company), HSBC doesn't know if that's enough and they'll have to get back to me. HSBC also has to have a final inspection on the job before even paying 30% again, even though all work and materials have been paid for and completed.
The inspection company, HSBC said would contact me and has never called to date. I called HSBC back and requested the name of the person to contact and the number to call. The inspection company will be out to inspect this Sunday. I've been a general contractor for some time now and have never seen a project managed this way by anyone. Ninety nine percent of the mortgage companies do nothing, but sign the depreciation check over to the owner of the property if it is less than $10,000. I could not call the person back who was calling me, requesting information or documents. I always have had to call back a different number and talk to someone first then maybe get the person I had spoken to or a different person who had no knowledge of anything that had happened.
I'm now waiting again to hear back if they have enough information on the worksheet sent to me by the insurance adjuster to get 30% back. I work everyday with adjusters and mortgage companies and this is what you could expect if your 6-year daughter was handling the claim. Very dissatisfied.

HSBC is so unethical! I laughed when I read that they are one of the largest banks in the world committed to customer service. HSBC bought our mortgage from another bank and so begins our saga of their "insurance company" buying insurance and charging our escrow - effectively, we would never be able to pay off our loan. In 2010, they tried to buy insurance for 3 years and charge our escrow over $3000. The horribly sad thing about this is that the policies were backdated. The insurance department insisted that we did not have flood coverage and they had to protect themselves.
Our insurance agent sent them letters and our insurance company talked to them. We highlighted the clause that stated "flood damage is covered.” Finally, there’s a complaint to the OCC resolved this. As our note was due to be paid off in April of this year, they again added flood insurance to our escrow of $360. I again complained to the OCC because our loan is paid in full! They also increased our automatic debit. I worked in banking and know this is not the way to conduct business. We are in the military and during our next trip to the states, we are turning this over to a lawyer as well as continuing to complain to the OCC. Everyone needs to do this! Complain to the OCC! Post on FB! Tell your friends and tell them to tell their friends. HSBC is unethical!

I sent in my monthly mortgage payment 6 days past due. The payment is $514.42. Normally, $290 goes to principal and the rest is towards interest. For the six days late, HSBC applied $491.24 to interest and $23.18 to principal. Apparently, the only explanation is that I need to pay on time better. The charge was $200 and some for 6 days late. The company got a little upset when I suggested that these were usury charges bordering on loan sharking. They are way out of line and I have noticed this happening before. I was out of work and past due before and now I am informed I have $8,000 in unpaid interest that doesn't even show up on my loan papers. Please help me get to the bottom of this.

We had a house fire in January. Allstate Insurance has sent checks. HSBC is our mortgage holder and cashed the check from all state over one month ago, but they will not release it for contractor's completion of our work so that we can get back into our house! We have sent HSBC everything they requested and have spoken to them - even twice a day sometimes. Our contractor has spoken to them. They give no satisfaction for when the check will be released with various reasons, most of which are that they didn't receive what we know they received from us (all papers went in the same envelope with the check that they cashed).
They told the contractor’s check was sent last week. Then, they say on the phone that they didn't receive something again. It's pure run around and we need help! Our insurance adjusters can't help and daily phone calls get us nowhere. We need the money to finish and the contractor’s finish date was April 15th, of which the bank is fully aware! We lost most of what we owned in the fire. We are very senior in years. We need our home! If you can't help, we would be most appreciative of any advice or names of where we can go for help! Desperation doesn't help with HSBC. Your attention is appreciated!

Misuse of my funds and unfair business practices: I paid my taxes, faxed, and mailed HSBC verification; yet they still paid my taxes, forcing me to pay HSBC back the money at an extreme rate (They added the amount to my monthly mortgage payment, raising it by 70 some dollars).
They also took money out of my intended mortgage payment to pay what they say were late fees; their system is made to take out late fees if there are any outstanding in the account. When a payment is made, you think you're making your monthly mortgage payment; yet they take out a small amount to make it short and the system sees you as being late. And this keeps happening, and in my case, they keep adding late fees, taking money out of my payments leaving them short then reporting to the credit bureau that I am always late; thereby, reducing my credit score and leaving me a hostage to HSBC.
I call Customer Service and other departments they transferred me to, but never do I get a resolution. Instead, I usually find my self putting the phone on speaking and being put on hold for usually 45 - 50 minutes. Then when someone gets on, I tell them my issue, and they hang up! These are just a couple issues of the many I have had with HSBC. I filed a complaint a few years ago with the Consumer Protection Office, and they said i should find a lawyer.

My husband and I have had a mortgage with HSBC paying a high interest rate for many years. Although it's tough sometimes, we have managed to make our payment on time with HSBC every month. Now, HSBC has reported us late for the last two months to the credit bureaus. Our credit scores have dropped over 100 points! Now, we cannot refinance our home or get any other type of loan because HSBC refuses to fix their mistake even after I have sent them proof of on time payments for the last year. I am extremely upset and feel hopeless. I wish there was someone out there that could help us.

I write this e-mail about doc # **, address ** Jacksonville, Florida 32208. I have been in contact with Mr. Steve ** at the collection agency and our agreement was $13,000. When I called back, he was back with HSBC now. I need something in written that they will agree on that amount. I have been waiting on that.
I have also spoke with Mrs. Shronda ** with HSBC. I have not received anything yet. Mrs. ** had a gentleman come out to look over the home but I have not heard anything. I write this e-mail because I have been trying to get this matter cleared up. I want to save this home. I have spoken to my bank and they just want something in written that $13,000 is an amount that you guys will agree with. I have until Sept. to get this clear up the home will be sold in Sept. for the taxes.
What I'm trying to do is make sure that HSBC get something to for the home I have gotten my bank to agree to help me with the back taxes. But I know there is money owed to HSBC too. I'm not Raeleen ** who is the home owner. I want to buy this home from what I'm getting she brought this home for her mom and grandmother who both have passed away mom in ‘07 and her grandmom in ’08. From what I understanding, her fiancé was killed in ‘09. Miss ** then has had a baby that was born with two holes in her heart that has taken her to have to have open heart surgery in 2010. So I write this trying to get this cleared up the auction for the taxes are in Sept. It was on the list for May but I went to the city asking for more time, they gave it to me. I just need something in writing so that I can get the funds also for HSBC to get this matter cleared up. I was told by Mr. ** and Mrs. ** that any balance own will be cleared up.
So I ask that they help me so that I can get the fund to pay this loan off. In Sept if I go to the auction and purchase this home, then HSBC will get nothing so I really what to clear up everything with HSBC and the back taxes. So please help me to do so. I have lost my home. I had been in touch with two of their reps who did not tell me the mortgage had been charged off. I can't rest until I get my home back. The investor kept some of my things. I have been through ** and it is not right because HSBC send an appraiser out last year and if there was no longer a mortgage, why did they do that? I need their help to get my home back. I was told lies my Mrs. ** at Ext ** who I started talking to back in ‘07 when my Mom passed away and Mrs. Sharon ** who I started talking to 2010.
Please HSBC, I need your help. I was put out of my home last Tuesday by the police. The Taxes Deed office did not send us anything about the auction and there are Florida Laws that they have to contact the owner so I’m fighting them. I need your help in any way you can because I stay in touch with you guys but I was not told the right thing. I am homeless now with my son.

I have HSBC for my mortgage provider and they suck big time.The only way I could save my house was to file bankruptcy Chapter 13. When all the supposed to be loan modification help was out there, I got none. Nobody could beat HSBC. All I got was a six months modify and no extension. I tried NACA for help and they said good luck. I tried the Chicago Urban League, no help. And I even retained my own lawyer, nothing could be done. The kicker is my wife and I can afford these payments now at 9%. We make good money. I just had an operation on my shoulder and was out of work about 10 weeks. I am tired of making these high payments on a house that is not worth it. I am just hanging in there because my son school is so close and I am in and out of town working. I am pondering on walking away when my son start driving because these payments from HSBC are too high.

In 2001, my husband contacted HFC from a letter we got in the mail addressed to him. He talked to the person there and set everything up. I got a call at work saying I was to go to the office after work and sign papers. My husband was there and I asked about loan amount and was told it was what my husband asked for. I asked about payments my husband said; he told me $160 and the guy just said what they talked about. I asked about interest rate and was told he and my husband talked about it. Lo and behold, after it was too late, I found out it was $160.00 every two weeks and 23.9% and the amount was way more than we were covering on 2nd. We paid and paid and got nowhere on this. Well, as time went on with some problems, we fell behind and they would not work with us and we defaulted. But luckily it was a 2nd. Then we had to go to court and they were so vague with the judge that we lost the case. Now, they started taking money from my paychecks, not my husband’s who was the borrower, but me the co-signer. What is the deal on this? Anyone else in Wisconsin has these problems with them?

I contracted an ARM loan which was sold to HSBC. Even though I tried everything and may lose my property due to health/layoff, HSBC refuses changing my 9-plus % ARM into a more manageable fixed rate mortgage. I had a modification done last year, short term, due to changes in my financial circumstances. After 6 months, the payment went back to where it was unaffordable for me. I asked for another modification in January this year and was on the phone in length with one of HSBC’s customer service drones. She ran a check after asking me plenty of questions and said I definitely qualified for a modification and after the 6 months to ask for a longer extension. I had missed my December payment but let her talk me into making it since they were going to do the modification. Making that payment caused great financial pain as I ended up with $160.00 in overdraft fees on my account as I had told her I wouldn't be able to afford it but I thought it may move things along. I think I made a mistake there.
I received a phone call today telling me that I needed to catch up on the past three months payments. I said I was waiting on a modification, so I would know what the payments would be and was told that I did not qualify and he would offer other options and tell me how to issue an appeal. I asked if I would be receiving anything in writing and he came back on the line and told me that they had just mailed the notification yesterday. I am making $4,000.00 less money than when I qualified for the first modification and now they tell me I don't qualify. I asked if I needed to make more money to qualify and was told that he couldn't understand why I didn't qualify.
No one seems to know what's going on with this company and they don't want to help. I ended the call by telling him that I would wait for the written confirmation of denial, issue an appeal and they could take the house.

We can match almost every complaint mentioned on this forum. I have been following every thing I was asked to do. As of this month, I am current; however, because they want me to sign a form that says I cannot sell my house or pay them off for five years, which I refuse to sign, they have started foreclosure proceedings if I don't pay this whopping amount within 30 days. No matter if I am current with what they asked of me. I called the Federal Trade Commission complaint department at 877 382 4357. They were very glad to take my complaint and referred me to several other areas for me to also log my complaint.
There is an investigation going on many banks, HSBC Beneficial being one. The news now has been talking about one of the biggest (Bank of America), but HSBC is also being investigated. They need to hear from everyone affected. They want you to call your State Attorney General's Office. The trade commission gave me the number to the one in Texas. They also were very helpful (Texas Attorney General, 800 621 0508). They gave me local numbers for legal help, help for vetrabs, etc. My first appointment with one of these is this week. I feel better just knowing someone is investigating these predictors.

We have been here over 16 years, and I don't want to lose my house and be homeless with the wife. I have no job and I just went on disability. I would love to work something out with HSBC. They have tried to help in the past, but the payment took over three of my unemployment checks and I just could not do it. Please just lower the interest rate to 5% and the payment might be around $650.00 so I can make that on time. Thank you.

We have an offer on the property and were moving forward on the transaction, when a lien (not mortgage) showed up on my clients title report. He has been faithfully paying HFC for a long time now and is committed to paying them off. However, they are absolutely refusing to take any less than the full amount to allow the short sale to be completed. We have offered several solutions, including getting them a large chunk of the balance at closing and signing an agreement to continue payments until the balance is paid off. But they will not offer any assistance what so ever. This is absolutely ridiculous, especially when the seller involved has been faithfully paying them in accordance with the payment agreement in place.

After years of paying high interest mortgage payments, most on time but some late due to a lack of fund, I tried EZ Pay. It went smooth at first, but then expired. Why can they only do that for six months? Not knowing it expired, I missed a payment or two. Well, they started calling twelve times a day, unable to answer until after they close (West Coast). I finally got a person to put me back on EZ Pay. She said, "I see you've been paying later in the month, would you like to keep doing that?". "Sure", I said, thinking they changed due date to match. Nope, two months went by before I got a letter saying I owed thousands because they were not only late fees, but no payments because it wasn't enough to cover the late fee plus house payment.
In Dec 2011, the EZ Pay expired again. No notice until after it was too late to make a "on-time" payment. Another late fee. I then spent an hour on the phone getting EZ Pay set back up, but it wouldn't start until Feb. 15, 2012. Okay fine, I'll make my payment in January myself. I paid online only to find out EZ Pay also made a payment. Yes, bounced check (ACH) twice fined by my bank and then got a $29 fee from HSBC! Sweet! So today, I spent 28 minutes of my lunch (30 minutes long) with HSBC once again setting up "easy pay". I think it stands for "Easier for us to PAY them MORE MONEY!". I'll refinance with someone else and I will never do business with them again.

HFC Predatory Lender - I have a 10.5% mortgage with loan with HFC and called them to get the interest rate lowered since I was sold on the fact that they would revise my rate based upon my payment history. Well, I was told they could not revise or modify my loan with them. I am ** off! They are sticking it to me at 10.5% and seems like I am stuck. But I went online and saw that they have been sued for this same reason so I am ready to fight! They are hurting thousands of people with little or no remorse. It’s time we stood up to these jerks! The going rate is around 4 % so I am requesting help to get my loan modified indefinitely with this bank. I am prepared to sue!

I had an issue with my main bank account in Nov. I immediately went onto HSBC's website to change my Ezpay to another account. I then called about loan modification and was denied. I also at that point verbally changed my account information because I was told that I could not do that online. In Dec. I again called (waited on the phone for over 20 minute) and finally talked with a supervisor, Camile. She assured me that this was changed and took one payment out of my account (12-12-12). Then, she said that I was set up again for Ezpay. At that point, I received a letter from HSBC stating that I was reinstalled in Ezpay.
In Jan. when the Ezpay did not come out as planned, I began getting phone calls every day or several times a day saying that I was delinquent. I sent a letter explaining everything that had occurred since Nov. 2011. I have not received any call or letter of explanation about my account and why I am unable to use Ezpay. I continue to receive statements with late charges of over $50.00 but have not had the courtesy of a call or a letter explaining what is going on. I have been a loyal customer for many years and feel that I have been treated unfairly.

Not only did they take me for a 9.490% loan even though I had a credit score in the 700's. They then in turn close their mortgage branches one month later in 10/08. They no longer do home loans or refinances. They put an arbitration rider on the loans and then make you agree to a two year window in which you are not allowed to refinance without paying about 12k in penalties. I waited patiently and by that time, the market crashed. The home value dropped and calling gets you, “I'm sorry you don't qualify for a modification.”
We don't follow Obama's new laws. We don't get money from the US Government so we don't have to help you. I'm sick of this company and the way they do business. I have contacted an Advocacy group who handles these kinds of claims and have begun to file injunctions against HSBC/HFC. I will not go into foreclosure because of these clowns. I am going to sue the crap out of them. I don't care if it ruins my credit forever. I hate them so much.

I fell behind in Sept. 2010 to 60 days late, where I set up payment arrangements and made a $250 payment on 9/23/2010 and a $450 payment on 10/6/2010. Unbeknownst to me, HFC applied my payment to someone else's account. I found out in Nov. 2010, when my account was sent to an attorney for non-payment. I called them right away to find out that they had no record of the payment and it was now up to me to prove it. HFC submitted my check as an ACH, which left me with no cancelled check and only a bank statement to prove that it was cashed. I called over and over, Wachovia called over and over, I wrote to the FTC, comptroller of the treasury, all 3 credit bureaus, Md. State Attorney General and whomever else I could find an address for. Finally in April 2011, I spoke with a rep who helped me out by researching my account. She finally had the payment applied with a transaction date of 10/6/2010, but a posting date of 4/17/2011. However, HFC never bothered to correct my credit bureau reports.
My credit score is lumbering along as they report a 60-day late for Oct. 2010, when in fact I was on time by then, and a 90-day late for Nov. 2010 when I was on time for one month by then. Whenever I call I get a rep who tells me I have to send in a faxed complaint. When I fax the complaint, I receive correspondence saying we have reviewed your complaint and determined that the information we are reporting is accurate. I have given them all the information to make some common sense findings and determine that they screwed up and posted the payment 6 months late, so clearly that impacted what they reported when they didn't apply it to my account. Yet still they do not see it. It's like no one wants to do his/her job there. They want to take the path of least resistance and keep the person in debt forever. I too try to make significantly more than the monthly payment and feel like the loan is going nowhere.

I lost my job back in 2003 and it has been an ongoing struggle to keep my home ever since. I have been give 3 temporary modifications, all of which I have paid, but as soon as it expires, they jack my payment right back up to where I can't afford it again and then they tell me that they can't help me until I am past due on the account by at least 90 days. I am more than willing to pay for my home and I want to keep my home but they make it so hard. I am told that they don't not have to follow the guide lines of the Obama Act.
Each time I call and speak to a different person, I always get a different answer every time except about the fact that they don't have to help me and that if I can't pay the regular payment, they can take my house. I am just about ready to let them have it. I have a regular job making good money and I can afford to stay in the house for a lesser payment than what it was in 2003 but they won't budge. They also do not report my mortgage to the credit bureau anymore. I was told that once your payment goes late that they don't have to report it. I just don't get that. This company is a joke.

This company truly has the worst customer service, ever. I cannot believe that of all the banks that have crumbled in the last several years, this one remains. I guess it is probably a result of their outright refusal to help their customers; therefore they haven't lost much money I guess. Has anyone received a modification? It seems like an impossible task to say the least. We have tried 3 times, to no avail. Now, I am paying a $135 late fee every month just so they quit calling me 50 times a day. And since they are not a prime lender, we have no chance of getting assistance. I have never dealt with a company that is so unwilling to help that they actually make you want to stop paying them. It makes foreclosure look good. Now we are so completely underwater, we are literally stuck with them forever. They certainly pulled out all the stops for us when we first financed with them, now I can't even talk to anyone in America. It’s the biggest regret of my life.

We have been trying to get a long-term modification for the past two years. We have done everything HSBC has told us to do including falling behind so that we would qualify. Lies! We have submitted every document they have requested over and over again. We have even worked with HUD (who by the way have told us we qualify) and the runaround continues!
My next question will be that in light of the recent news that they took money from AIG, now will they be required to do long term modifications? Why are international banks permitted to own mortgages here in the US but not have to follow the programs here? Still waiting for our modification!

I am writing to share my absolute disgust with HSBC and it's mortgage services. I have a Line of Equity that I pay each month. The President of the USA is making banks provide considerations for people unable to pay their mortgages, but someone like me gets no consideration. In 2009, I erroneously made a late payment. Since then I am unable to make my monthly payments online because of a freeze on the account. I don't even want to use the line at all. I don't even want to remain a customer at this point really. All I want to do is pay electronically, like I do the rest of my bills and the rest of the modern world, and not have HSBC treat me like I am a bad customer or I'm stuck in the 1940's.
They don't even make any sense. A couple of months ago, at the insistence of a customer service rep, I applied for overdraft protection, which later I realized turned out to be another line of credit that they gave me access to use but they won't even let me make electronic payments on my existing line. Does that make any sense? HSBC doesn't mind hitting my credit score by giving me another line of credit but they seem to mind me paying down my debt in a way that's convenient to me - the customer. This is utterly ridiculous! I wish someone can tell me how this makes any sense or is fair to me who has been a customer for almost 15 years! 15 years! With several accounts! Well, it won't be much longer that I will be customer.

Is this company above the law? Three weeks before closing our reverse mortgage, we attempted to print our mortgage information. Our account number did not exist, according to HSBC's website. We printed the information. Fax the information to the reverse mortgage company. How do you expect to close a loan on an account number that is no longer "valid?" HSBC had just cashed March's cashier check on our 7 year account number, and another problem arose. Are we supposed to believe accuracy on our 1099? Do we believe their website? Most consumers do.
How do you write a consumer about a "short sale" on an "Invalid" account number? Did they see our proof? Yes. Have they ignored our proof? Yes. We continue to see nothing being done, but letters of a short sale? Why are other companies held accountable for what they send to the internet, but HSBC remains untouched? We are 65 and 68 year old minority senior citizens, and we have been denied the opportunity given to other to enjoy retirement. We get to pay HSBC, until we decide to sell our home, and then who knows what the payoff will be? Laws have been written and executed, concerning internet fraud, scams, and deceit. We caught the error, before money was disbursed, and now our hands are spanked.
What happened to other seniors who did not have computers and printers? We hope we were the only ones. Our consequences are that we continue to be harassed with letters and threats of "short sale, continue to pay on an account number said to be "invalid", and accept tax documents that might, or might not be accurate, because after all, the internet said our mortgage account did not exist. How do you write letters of harassment and threats to senior citizens, who had 3 weeks before finalizing a reverse mortgage? When did HSBC receive the go they could go beyond internet law?

I have been paying for years on this loan. I missed a couple payments and now I owe more than the original loan was for. After all these years and the loan is more?! I see all the complaints above stating the same and worse.
Simply put… What can be done? Everyone files complaints but nothing is ever done. There is never any advice on how to deal with these people (if they ever would deal with their customers). Is there nothing legally that can be done? It is companies like this that cause the country to be in the situation we are currently in and that should count against them in some way.

I accepted a mortgage from HFC with promises of interest rate step down over a period of time. I was sold, they really did their job in deceiving me well. After a period of time, my interest rate went up. HFC stopped paying my property taxes and issued me a lender enforced insurance. I fell behind in no time and HFC made attempts to help only to be canceled with no proof of original agreement. All their offices closed and I fought for a modification.
After six months, I received a modification which was agreeable. Twelve months after that, my payment went up again and I was told ancillary fees were due, causing me to be three months behind in mortgage. My ancillary fees came out to $16,500.00 and they mercifully gave me four years to pay. I now must pay almost double payments for three months to get caught up. My credit is trash and I cannot afford to pay old debt keeping my credit score low. I wish I could refinance with someone else but nobody will touch me until I get to clean my credit.

I have an HFC account. I sent a lump sum to be placed toward the principal on my mortgage and to cover all deferred insurance.HFC seems to apply what they want, where they want. The company has long wait times. You can rarely speak to someone who speaks understandable English. I received several statements that are not for the correct amounts. Thanks.

This is a continuation of a complaint with HSBC, and our Constitutional Right to do a reverse mortgage. We followed the Federal requirements for a reverse mortgage. When we went to the internet to review our information before closing, we saw "an invalid account, no notice". We notified the other mortgage company of the problem. We faxed a copy of what appeared on the internet. We did receive (2) written explanations from HSBC, after time had lapsed for the reverse mortgage. The first statement said "we still have the same account number, and the second, months later", we do not know what happened to our website, and more about default. We continued to pay our mortgage, and make a notation of "an old account number on our cashier check, because we do not want to lose our home".
The remark about "default," did not ring a bell, until recently. We have received numerous letters concerning a "short pay". Was it possible that the internet account of an "invalid account number" was correct, but the homeowner was unaware? We feel we did everything we could in order to do a reverse mortgage. Our home is an important part of our retirement. We reported a discrepancy. We have had that account no. for more than seven (7) years, now all of a sudden it became "invalid".
We caught a major error before printing a reverse mortgage check on an "invalid account number on our behalf. Our problem was that our cashier checks always had our account number, and to find it "invalid" creates a problem with taxes and our reverse mortgage. How many accounts did we have with HSBC? Were we to sign federal documents when we had documents in question, of an account change for our reverse mortgage? Does HSBC owe us monetary compensation for their website?

In 2005 HSBC became the third service company on my mortgage. In 2007 I tried to refinance to get away from the arm only to be turned down for no reason. In 2009 when the economy crashed, I lost 50% of my income and tried to work something out with them only to be lied to and misled on what to do. After 18 months of getting nowhere, they stole my house and left out in the cold. My income came back and it was never enough for them.

Horrid! They are making our lives a living hell! We closed late with them in 2007 and they told us that they would send our closing documents. I called and called but they never had. I have no record of it whatsoever. My husband lost his job in September 2010 and it took 10 weeks to get employment. We got back pay and they said that they would do a 6-month modification if we sent in $1400.00. We did and they continued to say that we didn’t send the right stuff. For a year now, I have begged for a modification as my husband is now working though for less. They point blank told me "We don't have to help you, we, HSBC did not get help from the Government“.
I have 4 kids, the youngest has special needs, we have extra expenses with that, and all the therapies and neurologists, etcetera. We are losing our home and HSBC could care less! We did our part. My kids are emotionally traumatized. This is where we have raised them and now we have to move right after Christmas. I hope the corporate slug burn in hell for their criminal, greedy ways. Really? Instead of working with us, they will end up letting this home sit and rot. Since we financed with HSBC, we have put everything possible new inside and out in this home. I'm sick and I feel like running.

The mortgage interest too high. I also got roped into a revolving line instead of refinancing as a "temporary" 20k loan to add porch addition to my home. I was quoted an interest rate in the middle of my 1st and 2nd mortgage (about 12 %, I don't remember my loan papers stating a % rate and when I asked for a copy HFC sent me one but the signature does not look like mine). After the porch was built, HFC was supposed to reappraise and increase value so I would have enough to refinance/combine 1st mortgage (10%) and second mortgage (14%) at a lower interest rate and use the equity to pay off revolving loan. This was supposed to be over a 2-3 month period.
However, their appraiser shorted the value by 12k so I would not have enough to to what I intended. Only left 5k in equity to apply to revolving account at 22.5% interest! Now I am stuck with this stupid high interest account that they give me a modification $225.50/mo at 6% in 6 month increments, then they stopped the modification after 6 months. I have to resend all my proof of income (salary), cost of living, etc. In the meantime, they charge me $472 interest + late fees as the payment reverts back to the original agreement $451/mo at 22.5% with the statement that they may/may not approve the modification. They offered me a payoff of 12- 25k if I paid it off in 6 months. Even if they agreed to the 12.5 k, that's $2000/mo. They have ** my credit so bad I can't get a better loan.
I would like to be a member of a class action suit against HFC HSBC for predatory lending. Is there anyone else? I have no money for representation.

When the economy began to fail, my position at work changed and so did my salary and then I became unemployed. We were struggling and trying to get HSBC to work with us to no prevail. Hired a company to assist us in trying to get a permanent loan modification so we could remain in our home of 17 years. Once again, HSBC would not work with us at all. When asked why we qualified under the federal guidelines but not theirs, their answer was that they did not receive assistance from the federal government and therefore did not have to follow their guidelines.
We have now given up our home and moved from Florida back to Michigan to family. The house is gone as deed in lieu of foreclosure. They got a beautiful home that just had approximately $60k in work done two years prior due to a storm including a new roof. Basically, all inside had to be gutted and redone. We just lost all around.

I’ve been waiting for them to foreclose on this house for 2 years. I’ve not made a payment going on three years. I can no longer afford to pay for this place let alone the repairs. I’m on Social Security and disability. I’m sick and can no longer pay the pills or keep up the repairs. I filed Chapter 7 last month and told them they can take it. I wish they would just foreclose me and let me get it over with.

In 2001, I purchased a home. I put $50,000.00 down. The loan was sold to HSBC Mortgage. The loan was in my wife’s name because her credit was better. In August 2006, we divorced and I was awarded the house and the children. I modified the loan in 2008. In 2009 my ex passed away. I notified them of her passing and wanted to get the house in my name. HSBC said that they would send the paper work, which I never received. On February 1, 2010, I sent $3600.00 for the last three months. In March they called my step-son and told him that I had not made a payment in 4 months.
I received the check for $3600 back but it was in my ex-wife’s name and I could not cash it three different times. Every rep that I talked to at HSBC told me something different or a different amount. I hired a lawyer and HSBC said that they did not have to talk to me or my attorney because my name was not on the note. I tried to refinance the home and everyone said the same thing: the loan was in her name and that they could not help me. HSBC served me with foreclosure papers and the attorney has done a great job.
We went to mediation and HSBC said that they had found the modification papers and that I was on the loan papers. HSBC said, "Oh, our mistake and we will refi the house if you qualify.” I am out about $60k in legal fees. HSBC has violated many laws, I have found out. I don't know if we will ever get this to court in April of 2012. They have lied to me and my attorney. They have lied to a judge and I am not sure if they are not just too big to fight.

Over the duration of this loan, I have received calls at from 8:01AM - 8:50PM everyday at home, work, cell phone, and they have even called my sister, and father, because those numbers were listed on my original loan application (If the payment was 1 day late, or 30 days late, the calls never stopped). I took a loan with House Hold Finance (their name then) in November of 1996, for the amount of $5,098.84 with the ARP of 17.996% monthly payments less than $100.00. I was a first time homeowner, and a single parent purchasing a mobile home, and needed money for a down payment. At that time, I had no idea this loan was for 15 years.
I admit, over the 15 years, there were a few missed payments, due to unemployment and financial difficulties. I thought HHF was helping me, when I made payment arrangements, and put those payments at the end of my loan.
This loan closed on 11/28/2011, and my current balance is $4,336.14. By HHF records, I've only paid $762.70 in fifteen years! That is not the worst part. I have $5,557.18 in deferred interest! This is more than the original loan amount. The total amount due on the loan is $9,893.32. I have no idea what to do, or how to keep my property. If HHF forecloses on this loan, I will have nowhere to put my home. Any advice would be appreciated.

To posters here, I was in some of the same financial situations back in 2007 and just got relief last year through NACA. There were no fees associated for NACA to work on my behalf to get me a mortgage payment that is affordable. I did not know where to turn after trying to work with HSBC. The matter stems from a mortgage modification issue where a hardship existed. I was told by HSBC, the servicer, I was eligible for Obama's HAMP Program. After 2 years of submitting the same documentation and over 14 court appearances for supposed "mediation hearings" (in Philadelphia), I was finally granted a temporary modification, to which I strictly adhered. But I was denied a permanent modification based upon the same numbers I submitted to calculate the temporary modification. My attorney requested, through HSBC's attorneys, a screenshot of the numbers HSBC actually has. They refused to provide such, indicating the information is "proprietary". In the interim, HSBC calls me 4 times per day requesting $40,000.

When California's govenor took 14% of the state employees' pay to balance the budget, I called HSBC to get on the Obama plan. Arrangements were made, and my payments would be reduced to $279.00 a month. I was told this change was based on the Obama Plan, and my payments would be this amount for the next six months. I would be re-evaluated, and my payments would continue if I made my payments on time. I paid on time and managed to pay more than the $279.00 agreed on ($300.00) After the six months, HSBC raised my payments to nearly 500.00 ($480.00 I think). I told them I could not pay that amount and why so much. Their reply was that the interest rate went up. I was also told at a different time the interest rate for Adjustable Loans is 10%, and that is what they are charging me. What can I do to get fair and honest treatment from HSBC?

I asked to speak with someone in the U.S., and could not get anyone. I was on the line with them for over 30 minutes before I hung up in exasperation. I was connected to a representative three times during that call, and each time, the person was abroad and each one told me she could only transfer me back to the menu with no guarantee of speaking to someone within the U.S. I have had this problem many times with HSBC and decided to persist this time to see what happens. When I email them about it, I just get general responses telling me how to use that number, never addressing my complaint. I have kept the emails.

My 80-year-old mother and I are attempting to stay in this home. Since 2007, after being laid off, I have been attempting to work with HSBC Mortgage Services for a permanent modification. I was told to get a temporary modification, I was then told after three temporary modifications, I would get a permanent modification. Then, I was told to keep applying for temporary modifications. I was later told that HSBC never provides permanent modifications. I was ultimately denied a temporary modification. I kept calling to find out the status of the request then the customer service said that I was denied, and should find affordable housing since the new payment was $1600, which she said was not affordable.
HSBC sent notification that they had overlooked notifying me of the denial for modification. Collection stated that I would get nowhere working with HUD counseling. I would not get a modification and repeatedly and forcefully attempted to get me to agree to short sale. HUD certified representative was not very interested in helping since it's not hopeful. I had to politely insist for help or guidance. If foreclosed, my mother and I will be looking for low-income housing.

I have spent over two years trying to get a permanent modification which they could do and yet I find that they have not been able to do since 2008 or 2009.
HSBC is my mortgage servicing company. I applied for a mortgage modification in 2009 and since that time, they have been stringing me along every six months; just long enough to get me in trouble. I found out that they have not and would not give a permanent modification since 2009. I have been making interest only until they do modification.
In August, I got a letter saying that there would be no increase until the review in February 2012. Two weeks ago, I got a letter saying that they made a mistake. I contested it and did all they asked me to do. I got a letter yesterday saying that my new payment would be more than $1900 a month for 30 years. Please help.

I am a victim of subprime mortgage. I am a 60-year-old ** female on a fixed income. I should never have put into this deal. My home is worth less than what I owe. My interest rate is 10.75%. If I'm still alive by the time the loan is paid off, I will have given Beneficial over $500,000 in interest alone. I believe that I am a victim of and was targeted based on ethnicity, age, and low income area. I need advice. Where can I go to participate in any class action that might be pending against Beneficial/HFC for similar circumstances?

My husband called to see if they got our payment. They said they were recording our call. He told them that he was doing the same. Then they said it was against the law for him to do that, and that they would not talk to him. All he wanted was payment confirmation and to make sure they were not going to tack on more fees.
He ended the conversation. In the state of Ohio, it is legal as long as you tell them.

In 2008, I went through Consumer Credit Counseling, and my loan with HFC was accepted for CCCS program. All payments were made on time, and CCCS told me to ignore all notices. I made the final payment to CCCS for HFC in August 2011. And now, HFC is asking for deferred interest of almost $400.
Up until this time, CCCS has told me to ignore the notes on the monthly statement. I have tried calling HFC to find out what the deferred interest is, and they cannot tell me other than I owe it.

I have had lots of difficulties with HSBC, and share some that have been expressed on this website. At this point if they can't help me out with an affordable solution I will just be here until they foreclose. I cannot pay a $2,200 payment on a house, I purchase for $205 that is now worth $165k. I am no longer interested in a modification to save me a couple hundred dollars for a few months that only digs me a bigger hole in the end. I need a reasonable payment for the long term, what’s the hard part. Never again. I will start my description that HSBC mortgage is a horrible company. I requested a loan modification 6 months ago, and they were telling me that it will take 3 weeks to get done. But nothing got done. They will request my income verification and I will send them immediately and I will follow up with them if they received them and they confirm that they do. I will call three days later and they will tell me that they haven't received any paper work from me. I will hang up and redial the same number and another person will answer and say that they are working on my loan modification. After a day, someone will call me saying, "listen, we haven't received the paper work that we asked you therefore, no loan modification for you". I started faxing these documents every day and each time I give them a call to confirm that they received it. Now, this has being going on for 6 months and they are difficult people to deal with. The other factor is that I love my house and had had it remodeled recently spending $60,000. The house lost value, about 38% down. What should I do? I can not continue payment that they asking?

I had contacted them twice about the loan they have on my mother's house. They hung up in my face. I think it is predatory lending. The loan amount was 57,274.32 at 11.99 percent finance charge (154,654.08). Total payment of 211,928.40, deferred interest of over 15,000 now.
I do not understand how they are getting away with this.

We would like to participate in a class action lawsuit against Beneficial/HFC. We are in hard times dealing with ailing parents, financial help, college bills,etc. Our house note is ridiculously high. And with the housing market bottoming out, our loan is now higher than the value of our property. We have asked for help, and Beneficial/HFC is not willing to compromise. There is a huge lawfirm in Philadelphia which will perform a class action lawsuit. Please email if you're interested in moving forward against Beneficial/HFC.

I am trying to refinance my mortgage with HSBC. The appraiser from HSBC came to my house and reported to the HSBC's underwriter that I have window bar (security bar on ground floor), which caused a security concern in HSBC's perspective. To my understanding, my window bar has nothing to do to with violation of any building department code because there are other methods of escape in the event of fire. However, HSBC's underwriter demanded that I need to remove the window bar for security reason without any further clarification, and it is HSBC internal policies not to allow any window bar installed.
To me, this is unacceptable. I installed the windows bar solely for security reason, and HSBC tells me to remove it for security reason? Will HSBC guarantee my loss in the event of robbery in my house after the window bars are removed? Lastly, the silly thing is that HSBC said to me, "You can remove the window bars now so then I can process your refinance contract--afterwards, you can put it back." It seems to me that even HSBC employees were not convinced that removing the window bar is secure for my house.

Even though I'm not behind on my mortgage, these people call 5 to 8 times a day. They want me to pay the late charges that they have tacked on for the past 2 1/2 years. They are well aware of my situation. I have been going through a divorce for almost 3 years. I'm 64 years old and living on disability. I cannot sell or refinance my home until the divorce is settled.

Attempted to refinance with The HARP program but was refused because my mortgage is with HSBC. They are not backed by Freddie or Fannie, so you must deal with HSBC only. They offer no help to the consumer and just state they are not refinancing any mortgages. The loans are sold between these banks any the consumers are the ones that are suffering. We have no knowledge of who is backed by Freddie or Fannie. Something must be done to help all who wants to stay in there homes. Thank you.

We had a second mortgage with HSBC mortgage. On April 2010, we entered into a forbearance agreement. I wired money every month and in June 2010, I had a final payment of $2,200 and some change. Before I wired the money, I called to get the exact amount as I had received a statement with $1,600 balance. I was told that my agreement has been satisfied and I just have to make regular payments.
On December 2010, the mortgage was taken over by HFC. At this time, my balance on the loan was $16,000. When I received my first statement, it showed a past due amount of $5500. I called and I was transferred five times and then told that since the transfers were still taking place, they had no information but just make my normal payment. In February, I was told that the $5,500 were fees I had not paid. It took another two months to get the breakdown of those fees. In the meantime, they upped my balance to $22,500 and then upped it again to $29,500.
I have faxed letters disputing this and called several times. I am at my wit's end with this company. They have added over $13,000 to my balance and will not answer any questions and claim they never receive anything.

I had been granted a 6-month short term modification after my mother's illness and subsequent passing created significant financial burden on my family. After the 6 months of paying timely, I submitted the required paperwork to request the permanent modification, whereby I was told my modification was a mistake and they would not be reinstated.
This happened in 2009-2010 and I have continued to pursue assistance from them as the $50,000+ debt I absorbed with my mother's illness is still being repaid. Of course, during this time my husband’s hours were reduced and we had less income to support the excessively high debt and mortgage payments.
I was informed by the loss mitigation team, and this is verbatim, "My mother's illness or death was not their fault and my inability to manage money created this issue". This lovely individual went on to inform me that Obama says I can afford my mortgage, to which I simply replied, "Then please ask him to come to my home as I try to pay these bills with a significant deficit and 170,000 in negative equity."
She hung up on me after that comment. I continued to send over 211 pages of documents to them that they requested and, somehow could never seem to find even though I had fax confirmations. I honestly do not know where to go with this organization, but considering my house is worth 54% less than it was 3 years ago, which does not afford me an opportunity to refinance.
Additionally, I have reviewed my closing papers and have found significant discrepancies in the margin % for the ARM (which adjusts in January 2012). Once that occurs, I will certainly be in foreclosure. I have tried everything they have asked of me and still I am denied.
I need some direction as I also paid a "home modification" company to assist, who graciously took $400 and never provided any service at all. I do not wish to get involved with any other scam artists preying on innocent homeowners but I am at the end of my rope with this situation.
Please provide some direction.

We have been trying to get a loan modification from this company for almost four years. All they will do is put us on a repayment plan that makes the payments higher and continually report to the credit bureaus that we are delinquent.
We are 67 and 63 years old have had our home for 17 years and now we will lose it. I am on disability and we have a son and two grandsons living with us who cannot find jobs. Without our home, they would be homeless.

I have a mortgage with them. I became unemployed in October 2006 and I called them for a loan modification. They have given me a temporary loan modification and since then every 6 months, I have never been late and I always paid the amount they required. Every time I sent documents to renew the modification, I requested a permanent modification but they would not. I have repeatedly ask for statement of my accounts so that I can see what has been added to my balance, and show what has been paid to principal, and what has gone to interest. One time, they sent a statement that was not readable unless you worked for them, or maybe not at all.
Now four years later, they are refusing to renew my modifications. They do lending by false documentation and lies. Many people are in the same mess with them as myself. Please help us stop them from taking our homes.

Our original mortgage was bought out several years ago by Beneficial. We didn't pay a lot of attention to our statements, expecting our agreement to continue as it add with the previous company. We began to notice that the amount applied to principal changed every month, with many months being "0".
I called to question this practice and was told that I had not made a payment last month, so nothing was applied. I argued with Rick (no last name, of course, and, he didn't speak English well, so who knows from where he answered) that I had made a payment, giving him the check number and date it was written. He then told me that if the payment wasn't made within 30 days from the last payment, we were charged interest.
I asked then about other "0" amounts and found out that when a payment isn't made within 30 days of the last payment, I am charged interest and that the payment isn't big enough to cover the interest from the late payment and the current payment. My payment is almost always there before the due date but apparently that isn't the date used to determine if its late or on time; the date of your last payment is used. That is stealing and is wrong. We have been paying on our mortgage for almost ten years and have only reduced our mortgage about $26,000.
At this rate, we will never pay off our house and we plan to re-finance our home as soon as possible. What a bunch of crooks! This has kept us buried in a mortgage with no possibility of paying it off.

I had fallen behind in my mortgage payments due to health issues, tax issues, emergency home repairs (AC). I'm not accurate on the dates but it started about a year ago. I was contacted by HSBC and told how I was going to make my payments. He asked what days of the month would be best and I explained that I couldn't be sure, that I would make the payments as I was able to collect the funds. He insisted that I give him days, so I tried my best to do so. But knowing that it may not always work as other payments were also coming directly from my account. He then spoke of a six-month plan based on my other monthly obligations.
I explained that I had little of that information in my head, but attempted to give costs of fuel for my car and my wife's, utilities, etc. He did not want to know about car payments or other bills. He explained that I made enough money to make the payment so he couldn't help with the lowering of the payment. I got screwed from the get-go with HSBC but now, like some others, I have been making some payments and slowly catching up. I spoke with the representative today and was told I would need to provide a certified check for each payment from now on until November. My question is, what if I don't and just send a check? I would love to tell them to take the mortgage and shove it up their **. They are the worst of predators - the scum-sucking sludge of the mortgage world. I would like to say what I really think.

I was behind on payments for a few months due to layoff at work. I wrote them and called them (HBSC), no response. Took me to court, put lien on my house ($6000). Turned it over to attorney who wrote me and said to write, not call. I wrote two letters trying to arrange payment, no response; sent two faxes trying to make payments since things had turned around, no response. I am making payments, hired attorneys, will never deal with HBSC again.

In 2010, I got a settlement from divorce for $25,000 and I had another $1,000. I called, called and called HFC to get them to settle the account for $26,000. It took forever to actually get a person on the phone then all I got was transferred from person to person. They all told me different things and I kept asking for a supervisor. I called many times over about a week and I got the same results over time so I decided to send the $26,000 at the time my statement showed a balance of $25,300. When they got my payment, they sent me another statement wanting almost $4,000 more from me. I called and of course, after getting the run around transfer many times, I was told that was the interest on the loan. Then I was told that I shouldn't have sent the $26,000 because they might have settled for that amount. What! I was told by many people including a supervisor that HFC does not settle mortgages.
So now, I owe them almost $4,000 which I am now ready to pay. I wonder how much more they will want this time. Oh, I forgot to mention that my mortgage is paid ahead to 2021, 10 years ahead and they still want more out of me! So now, I am ready to try once again to get them to accept what I have that I can pay. They are impossible to contact! There are three phone numbers on my statement. They all go to the same recorded message and none of those numbers gives you a human. I looked on their website and there was another number listed. I tried it and of course it went to the same recorded message. I filed a complaint with the BBB and looked HFC up while I was there. According to the BBB, HFC has been out of business since 2009. They recommend customers to seek advice from an attorney.

On September 23, 2010 our beautiful home in Harrisburg, PA burned almost completely to the ground. As our mortgage company, your insurance department was immediately notified of the loss. Subsequently, our very thorough and up-to-date homeowner's insurance company, NGM Insurance, estimated the damages to be $285,023.05. They issued a check for 75% of this amount or $241,428.01 (#**) on January 27, 2011 made payable to both HSBC Mortgage Services and me. The check was overnighted (FedEx Air bill #**) to your loss draft department. Today is Sunday, April 24, 2011 and we have still not been issued one dollar of these monies in order to proceed with the rebuilding of our home.
We have written, faxed and called your loss draft department regarding procedure and protocol more than a dozen times. Having experienced this traumatic loss now for more than seven months, we are more than familiar with the verification and documentation process and have submitted and resubmitted more than 100 pages of documents and approvals, following very carefully the numerous and inconsistent instructions and directions that your more than 10 different customer service representatives had given us. Each and every time we call, we are connected with another, inexperienced, customer service representative and each one has a varying perspective on the rules and regulations regarding the distribution of the monies from the check.
In the meantime, our home builder, which was subcontracted by me as I am named the general contractor on the account and I am purchasing much of the construction material myself with my own funds, has not been paid the first draw and is nearly halfway through the building process. The second draw is due now and we have requested a home inspection to take place so he can move forward and attempt to finish by the deadline, July 31, 2011. Additionally, no one has responded to our request for inspection.
Exactly three weeks ago, on April 4, 2011, your department claims a check was issued to Yingst Homes (in the amount of Yingst's first draw, $67,701.50) and to me, the general contractor, in the amount of $11,877.50 for the purchase of our kitchen cabinetry at Home Depot. All the necessary documents had been faxed and verified by your processing department as received. Not only did we never receive these checks, which another one of your representatives claimed were mailed a week later when my husband phoned in to check the status, but now, after three weeks, another of your staff has also stated that no check was mailed to me in the amount of $11,877.50 and $72,428.40 (for the first draw to Yingst Homes) was sent to a random address (wrong house, wrong zip code) which we never gave you.
As of Friday, HSBC employee, Darnell (no last name but calling at 866-567-4029, ext. **) is saying we will not be reimbursed for any of our expenses as general contractor until the end of the project. He also said that he is unable to resend the initial payment to Yingst Homes until at least Tuesday, April 26, 2011. This is unacceptable. We are attempting to be the steward of these funds by conducting almost all of the footwork on product purchase and negotiation ourselves in order to facilitate the finest reconstruction for the amount decided by NGM. This is the reason is why, upon the suggestion of Maya in your customer service department, I made myself General Contractor. She said if I did, we would be reimbursed immediately for any out-of-pocket expenses as long as I faxed a receipt indicating we had paid for products and services. In fact, she said it would be issued within three business days of receiving those receipts! This is only one example of the conflicting and inconsistent information members of your loss draft staff have been given.
We are out of our home for almost eight months. HSBC has had $241,000 of our rebuild money since January, 2011 (it is May, 2011 as of writing this) and we have continued to make timely weekly payments on a mortgage on a home that was burned to the ground! These folks have flat out lied to our faces about checks being cut, addresses they were mailed to and correspondence received.

Back in September of 2010, I put a stop payment on an electronic check for my mortgage. I called HSBC to let them know that and I reinstated 3 days later. I sent the new payment in 3 days later. The following week, I received a call stating that my payment had not been received and that my bank account was closed. I assured them that my account was not closed, has never been closed and has been open for over 10 years to no avail. I argued the fact, but they would not resubmit the payment. I had to send them a cashier's check and was charged late fees on top of that. I was then told I could not make online payments for a period of 6 months and I would have to pay by cashier's checks that are costly and very inconvenient for me to get.
I proceeded to pay via cashier's checks for a period of 6 months. I was told by HSBC that as of March 29th, 2011, I could now make online payments. On April 6th, 2011, I made an online payment for my mortgage account. I received a call 3 days later stating that the payment had been returned due to account closed. I told them that the account has never been closed and they had made a mistake. They asked me to have the bank fax them a letter stating the account number and that the account was active. I did that on April 11th and I called HSBC on the 12th of April to see if they had received the letter. They had!
On the 11th of April, I made a payment by phone per one of the customer service reps. They assured me that the payment would go through as they were getting the letter. I received a letter in the mail on the 15th of April, stating that the payment had been returned due to the account being closed. I called HSBC and spoke to 3 different people in regards to the situation. They then told me they would have a supervisor call me within 48 hours; a Mr. Nick **, I'm not sure of the last name. He has never called as of this date. I called my bank twice and they stated that they had received no electronic request transfers for payment from HSBC! A customer service rep by the name of Jed called me back from HSBC and stated they needed another letter from the bank with the routing number, account number, etc. I asked the bank to do that and they faxed the next day.
On Friday the 15th of April, I received a letter from HSBC stating that I needed to request a form from them to reinstate my EZ pay account. I have never had an EZ pay account, I make payments online at a one time set per month. I was also informed in the letter that I would have to make other arrangements to make my payment as they would not accept payment from my bank. I informed HSBC several times during discussion that I was not going to pay any late fees, return fees, etc. They agreed, but I have nothing in writing. I am sending them a check today from another account for the April payment. I have spoke to these people for hours on the phone, you cannot talk to anyone in authority, no one calls you back, they do not hesitate to call and try and collect over the phone, and call several times to the point of harassment.
I want to make my payments on time and they are doing all they can to prevent me from doing so. My bank account has never been closed and HSBC is basically looking at their computer system and seeing that a statement was made that my account was closed and refusing to fix their error. They are impossible to deal with and their service is ridiculous, along with their outrageous interest, etc. I would like to be able to make my payments online without hassle and **.

Local servicing offices closed a few years back. Company does not assist in negotiating mortgage interest rates when having financial difficulty. They prefer to arrange a short sale rather than modify the loan.
I am trying to cooperate and make partial payments. Payments remain unapplied and late charges continue to be tacked on. I am in jeopardy of losing my apartment.

I was horrified to receive a notice that I am being charged for interest accrued even though I was informed by an HSBC representative that if I deliver the full payment by the statement due date, I would not be charged for interest accrued over the promotional period. In mid February, I called customer service after noticing that the promotional period due date did not match the statement due date. As you will notice upon inspection, my payment in full was received February 7, 2011, the statement due date. I waited until the statement due date (which I was informed was ok by the HSBC rep) to transfer money from another CC account to pay this. Upon calling in February, if I was informed that January 28th was my only option, I would have arranged to make the payment then.
Shame on me that I did not take the name of the representative that informed me that I would not be penalized if I paid my payment by 2/7/11. Also, shame on me if I did not record the conversation! Maybe HSBC did. If so, please review my past discussion with your representative.
If there is no resolution to this matter, shame on HSBC and/or its representative for pulling what appears to be a dirty scam on a customer through deception. Considering the tough financial climate we are all dealing with, let alone my personal financial challenges. It is amazing to me that I am being put through this stressful situation through these actions by HSBC.
In closing, I would hope the powers that be at HSBC will understand my position and resolve this matter by considering the actions taken by me to pay what was due to HSBC in good faith in the time-frame I was told was adequate.

I believe that I am being charged too much for interest. I called this company on the week of March 9, 2011 to check my new balance after mailing a check of $233.00 which they received by March 4. My new balance was $10,582.00. I then checked on my pay-off amount and it was 10,853.09. I didn't think they charged penalties for pay-offs. Anyway, this would be my pay-off if made by March 24, 2011. I could not make a pay-off amount so I mailed a check for $9,600.00 on March 12, 2011 which they received on March 14, 2011.
Now they are telling me that I owe them $1,187.12. I took the new balance mentioned which is $10,582.00. This is what they told me after receiving my first payment of $233.00 and then to subtract the other amount I sent amounting to $9,600.00 then I get $982.00 as my new balance. But they have tacked on another $204.51. I made two payments to this company this month: on March 1, I mailed $233.00 and then on March 12, I mailed $9,600.00. Both of which they received before March 24 which is the date when the pay-off amount was due. They should have taken the quoted new balance amount to be $10,582.00 but they tacked on another month of interest and then deducted the $9,600.00.
I do not believe this company is reputable. Through my problems, I am trying to get out of debt. I never want to do business with this company again once I get out from them. Even as I went back to school last year and I was not able to continue my job because I had a back surgery, I made payments the best that I could. I did get behind but with an interest of 24% which it is like being in a dark pit. They don't really offer any ways to help you either. What this company is doing is unfair. I think their practices should be investigated.

They have been told not to touch my taxes but they pay some of them anyhow, which adds interest and penalty to my loan. I'm tired of this company, I'm ready to sell so I don't have to deal with them anymore. Also I had a flood and the insurance company sent HSBC the check, which they would not release until I did the work and until they sent their people out to see if the work would pass. Well I don't have the money to do it. I thought that is what insurance money is for. HSBC never released the money, they still have it. I'm sick of this.

After falling behind in my house payments due to my husband's cancer, I was able to catch up after his death with life insurance benefits. But ever since then I keep getting charged with all sorts of fees including forced placed insurance when I have insurance already. But because the loan is in my ex-husband's name and not mine, they refuse to accept it; although they have in the past. They also do not recognize the quit claim deed filed in the courthouse.

I've been dealing with this company for my mortgage for two years, and I cannot comprehend how they can be this inept. HSBC has four, yes, four separate mortgage companies, yet they are all named HSBC publicly which means if you want to make a payment or contact the company, and you don't have your mortgage information on you at the time, you have to wade through website after website, or 800# after 800#, trying to find out which one is your actual lender.
Again, this is incredibly confusing because they all call themselves HSBC.Yet, they're independent companies. What the **!? Dear HSBC executives: Customer service rule #1.Make it easy for your customer to find you. Speaking of websites, what 4 year-old is designing yours? Making a payment is so incredibly difficult, and the menu navigation is so non-intuitive, I feel like carrier pigeon would get my payment to you faster. I'm selling my property in December, and I will never use this bank again.

I received a threatening phone call from collections department of HSBC. They said I owed them a payment. I was actually sitting near a computer so I pulled up my bank account. I send my payments via cashier's check that I originate from my bank. I informed the person that all my payments to them cleared and he demanded I fax him my bank statement. I said that I had no proof that he was actually a HSBC staff person and I did not feel comfortable sending a fax with such private info as account number to a fax number I couldn't verify. He got rather surly with me but I told him I would call back from the number I had on file for HSBC.
It turned out that my Sept check which was sent to them was never cashed. My bank verified the date it cleared the check number and confirmed it was sent. October payment was received and cashed. I sent it to the address on my statement but my bank told me it HSBC wants all their payments routed to an address in Maryland. Is it my fault when I paid in good faith to the address they provided me and they lost my check and have the gall to charge me late fees? I always send more than the minimum payment as well.

I took out a line of credit loan at the beginning of 2007 for $12,000 to take my grandson (then 11) on a special vacation to commemorate his parents' passing. The interest rate while not ideal was reasonable. I believe that I made one or two late payments due to an isolated hardship and my interest rate shot up to 29.9%. I have made on time payments the last two years and have paid off exactly $8 (I called to get payoff today and it's $11,992.87). How is this any different than a loan shark who may or may not break my kneecaps? I have now given them over $12,000 already and yet I've only paid off $7.13? Really? Can someone, anyone, please tell me how this is legal, ethical, moral? How do these people sleep at night? On loads of cash, I'm guessing.

I had lost my job, so we were on a temporary loan modification for 6 months so that we could get locked in for 18 months. We made 5 months worth of payments on time, and in full. We called to make the 6th payment and were told not to make it, because they were processing the 18-month loan mod. We were told to call back in the beginning of December to see what our modification would be. We called back, and were told that we were 8 months behind on our loan payments. They told us we had broken our payment arrangement, and now had to come up with the full amount. We were then told by an HSBC rep that loan mods don't really help, and that he was not responsible for the advice the other rep had given us to not pay our loan payment.
We were told we had until the end of December to come up with $3400.00 to get us out of mitigation. We were served a notice of foreclosure on December 23. We called to ask what was going on and were informed that the person who was handling our case was on vacation, and would get back to us when he got back. By the time we got a response from someone at HSBC, we were told that we were only 124 days delinquent! That was 2 days before our court date. We were given 6 months to try to reconcile the situation. We called back to HSBC and were told we were still 8 months behind!
They wanted us to come up with $18,000, which they "generously" cut down to $9000, to keep us out of foreclosure. Our house payment, if we would have been able to come up with this, would have been $2000 a month on a $40,0000 house. Basically, we had to get out, and HSBC bought the house back from themselves. We were in our home 7 years, and still owed the entire principle, plus interest. Our rates went from 9% to 14% between October of 2005 and January of 2006. Our note says it can't be moved more than 1% every cycle. Our last change occurred October 2009, and they lowered it from 12% to 10%. It's illegal according to the note we signed. There were also fees that HSBC could not explain, but were still going to charge us.

HSBC granted me a loan modification trial in July of this year. The agreement stipulated I make 2 successive payments of $1339.45 due by 8/8 and 9/7. I sent my 1st payment on 7/31 and my 2nd payment on 8/31. I had no problem with my 1st payment. On Sept 15, I received a letter stating my 2nd payment was late and they wanted $7800 by Oct 10.
When I called HSBC, an associate told me there was nothing they could do, and they would put my home into foreclosure if i didn't come up with the money. I called back the next day, very upset. A different associate told me to fax a letter to the hardship department, explaining what happened, and to call back in 5 days. I did fax a letter, and called 5 days later, only to have a different associate tell me to send my October payment in and not be late. On Sept 30, I sent $1339.45 via UPS Next Day Air to 2929 Walden Ave Depew, NY 14043; the letter was received on Friday, Oct 1.
On Tuesday Oct 5, the funds were still in my checking account,so I called HSBC again and a different associate told me that my letter was denied by the hardship department and HSBC now wanted almost $10,000, and my check was being returned to me. Not believing what I was hearing, the associate in a very arrogant and condescending tone told me to borrow the money from friends or family. When I said that wasn't possible, she said there was nothing else she could do. I asked her if I could speak to a manager in the hardship department or to someone in charge, but she said no. I called back a little while later still in shock that my home was being threatened to go into foreclosure, yet another associate told me to reapply for the hardship, fax in the information and call back in 10 days.
That night I found the telephone number for the office in Depew NY. On Fri Oct 8, I called the HSBC office in Depew NY. I was told by a lady who refused to give me her name that they can be very lax at times to process payments that come into their office, and the time frame for my Sept payment was around Labor Day weekend, and she knew that some payments that came into that office on Friday, Sept 3, or Saturday, Sept 4,were not being processed till Tuesday, Wednesday or Thursday of the following week. She would not give me her name when I asked again, but did suggest that I contact Consumer Affairs or the Justice Dept. When I called HSBC again and told them I would supply documentation to prove the money was in my checking acct in the beginning of Sept, they didn't want to hear it.
So now they send my October payment back. I feel like I am being set up to have my home taken from me. I have been in my home for 21 years and have every intention of paying my obligation, but I just needed some help during these hard economic times. I feel HSBC wants to throw me out. I did reapply for the hardship, I faxed all the paperwork in, yesterday Oct 9. If they refuse me, now I will fall further behind.

I had an armed loan with HFC, their sister company. My loan went up and up. I filed bankruptcy and never reinstated with them. I just kept paying my note. HSBC purchased my note. After the payment went up again, I call out them to see about refinancing. I told them after them treating me to sue me for the difference, I never reinstated with them and they cannot due nothing to me.
HSBC refinanced me on the spot with a bankruptcy and not making enough money. I call this predatory lending. They said one of their appraiser will come out to appraise the house. This person appraised the house for 3 bedrooms, finished basement and garage at **. I have 1 bedroom, not finished basement and the garage is on my other property, which has nothing to do with the one the want to refinance. Their sister co. HFC was aware of this.
I am 64 years old and a legal resident alien since 1966. There are some things I don't understand. I live in this old 1940 build house which was a HUD home when I purchased it. No HSBC Mortage services like to steal my house, talking about shortsale, etc. I need help.

HSBC double paid our homeowners insurance and we paid HSBC back the one overpayment ($1339.00 annual. We have copy of cashed check) since April 2010. They have called me six times and were told each time that this was paid. Even went step by step. Yet, they refuse to send me a letter acknowledging payment and still call and send letters to ask for the "shortage" that does not exist. I have become very stressed and fearful of the damage they may be doing falsely to my credit rating. I have become afraid to answer my phone.

I believe that I have been purposefully misled by mortgage and finance representatives of HBSC Mortgage USA into a financial commitment that would result in the possible foreclosure of my home or extended loan repayments at a higher APR rate than was promised. Based on the information they provided me , the loan representative led me to believe that after two years of loan repayment at a set APR rate, I would be able to refinance my loan to a lower rate. Since I already had three loans with this company (a home equity loan, mortgage loan, and a vehicle loan) and I was current with my payments, I asked the company for a modification or consolidation of home equity and mortgage loans to take advantage of a lower rate.
The HBSC representative said that they could not comply with my request but that their six month Hardship Modification Program was similar to what I was requesting. I was told that I would make timely payments at a rate that fit my budget during the time period based on their acceptance of my hardship description. The representative assured me that I would be automatically renewed every six months as long as I provided them with information showing my hardship.
After two years in this program, the rep told me that I would be eligible for a lower overall payment. I understood that I would be paying for an extended loan period, but the lower payment was what I was seeking. I complied with the terms for one and a half years as I was lead to understand them. I made the assigned payments on time and in June 2010, I sent them the information showing that my hardship conditions had not changed just as I had the previous six months.
Now as of September 2010, I was told that my six months hardship was over back in July 2010! HBSC had taken me out of their program, set my loan payment back to the amount before my enrollment into the program. HBSC did this without notifying me and waited two months before sending me a statement showing me the changes. That is when I was informed that I was two payments behind and my home would be going into foreclosure! Based upon their guidance, I have committed a great deal of money and time into my home (remodeling and making accommodations to provide care for my elderly mother) and now it seems that I was duped into making a bad financial decision by HBSC that could lead me to lose my home. Had I known, I would have definitely not made this commitment. I would not have invested so deeply based on a lie. I desperately need help in getting back on track before it becomes too late.

I lost my job last summer 2009, Called HSBC to ask for help, I was put on a forbearance program with a lower payment, submitted all paperwork as per their request by the due date. Received letter in mail six month's later "You did it" you made the Trial Modification make your new payments for three months on-time and you will be put in a permanent Modification. made all my payments on-time and called every month to follow up on my account status.Every time I called I was told everything looks good.
July 30th, I received a letter stating, "You are advised that your recent request for a modification of your existing mortgage loan has been declined. The decision to deny your request for a loan modification is based on our inability to create an affordable payment equal to 31% we gross $2545 and our normal mortgage payment is $945.88 ( we purchased home in 2007)also its a Fannie Mae loan.
When I called and asked what this meant, the agent said, "Oh you were declined for a in house modification we have other programs like HAMP." I just started the trial in June of 2010 and already have been declined something doesn't add up! But yet I was to continue making my trial payments. Saved all names and agent numbers of people who I spoke with.
My trial ends in August of 2010 and I was supposed to send more documents again by September 2 to process my permanent modification. Sent documents on August 18th early then was told to call this #1xxx-xxx-xxxx once a week just in case they needed more info. I called once or twice a week because when I would call on a Tuesday, they would tell me to call on a Friday, so on and so on! When I asked if they had everything they would say, "Yes, we received everything," that they are still processing my application.
Meanwhile, I kept getting calls from their collections dept. I would call back at my convenience when I would give them my loan # they would tell me, "Sorry, you're not on file." My reply then, "Why are you calling me?" This would go on at least two times every other day. On August 27th, 2010, I called and spoke to a Kinisha agent # xxx and she told me she didn't know why they were bothering me because I was approved for the permanent modification and I should be receiving my promissory notes to sign and my payments would be the same for five years.
Meanwhile, I am waiting for the documents to sign and I decided to pick up the call from the collections dept. and asked them why they still continue to call, still receiving the calls and finally, I answered on the agent told me that they need two documents resubmitted and the other document was to be a written itemized expense sheet. I asked why is this being dragged out. This has been going on a year and every time I call there is a different answer. Reminded her of my conversation with Kinisha on 8/27 and she said, "Oh no, you were declined for the HAMP program and we are trying to process something from in house."
I told her my letters state otherwise and my debt keeps getting larger and as of now I owe $6,000. I asked her how does my status go from approved to still processing and that they need the same two documents I sent on August 18th? I stated that there are too many inconsistencies and seems that they are very misleading. I faxed the documents the following day from an HSBC branch again!
I called to follow up on my fax and spoke to a Ms. ***. When I asked to speak to a supervisor, she got a little winded and said, "You might not need to speak to a supervisor. I could help." I told her I needed answers and gave me the song and dance on how they needed more documents and ya di dada then she asked me for my monthly payment. I told her that I paid September payment on the 1st at the HSBC branch and she went on with the balance I owe and said she was going to ask what I needed to pay for October after being on hold for a good 10 min. She said, "Well, I have no answer but to continue for now making your trial payment and you should really be making the regular payment." I asked, "Well, which is it?"
So I don't ruin my chances of being declined again somehow. She told me, "Well, don't take it in a wrong way but try not to think too much, just let them do there work!" I told her this is my home and I have children to think about and I need to know what is going on. This has been going on for a year I am afraid to struggle to make my normal payment and risk the help. I am very stressed and need help!

Do not do business with HFC for personal loans. In 2006, I took out a loan at 27.9% and due to economic circumstances, I requested a permanent loan modification to 6%. It was denied. In this world of record low interest rates, this is criminal behavior designed to annihilate the consumer at 27.9%. These people are ruthless.

Mortgage rate is at $11.9. They always say they will give me a modification, but it’s always temp for a couple of months. So many rules have been handed down from government. I really don’t know my rights. Credit too bad for refinancing. My next choice is to move out. Stressful.

I have been current on my home loan through June 2010, on June 15 I submitted a request for loan modification assistance to the bank. I received a phone call 2-3 days later stating that my request had been approved and my new modified payment would be 936.36, he also advised that I had an advance payment of 205.71 that also had to be added to that amount. I did state to him that the entire balance owed was just the 205.71 and would only need to be paid for the month of July to finish out that payment. He stated my two qualifying payments needed to be done by July 15 and August 15.
At the beginning of July, I contacted HFC to set up a payment for July, rep stated system was showing her the full payment of 1538 being due, but she could tell there were notes as to my having a loan modification approval. This particular rep stated I needed to speak with the loan modification department to have them correct the payment due (yet no one could give me their number directly). I was transferred to some extension where I was on hold for over 30 minutes without anyone picking up. Being at work that day, I was no longer able to continue to hold. I tried to call back again was transferred and again held for over 15 minutes before I again gave up. I then decided to go ahead and mail the payment in for July and mailed 1142.07 on July 2.
I called on July 15 as I had not seen the payment come out of my checking account, rep stated check had not been received and for me to issue a stop payment and do a new payment that day. I informed the rep that I would not do so, however I did agree to schedule the payment for August and scheduled that for July 31 in the amount agreed of 936.36. In checking, my bank account July 17, I was finally able to see that HFC did cash my check and it was in fact dated as received by them (on the check) July 14. Payment came for July on August 3. I assumed all was okay with my home loan modification request. Noticed many calls on my home phone from an unidentified # received during the day. I happened to be home on August 7 and answered the phone.
Rep immediately demanded payment stating my home loan payment of 1538 for August had not been made. I told him he needed to have someone review my account, a supposed supervisor was then given my phone call who stated he did show my two payments and the modification department would be contacted on that coming Monday August 9. I then called the bank again on Monday August 16 to check and was told my modification request didn't go through because I didn't pay the loan advance payment for August which was now even owed. I again explained the entire situation to another person who said her name was Mrs. ** she gave me an # and extension and told me to call back on Wednesday to check.
I called Wednesday, got a voice mail, received to return call and tried again the same extension on August 20. Woman I spoke with said she was in the loan modification department and the issue wasn't the advance repayment but rather that I had only made one payment and not two. I stated to her that I made the payment on July 14 and July 31 - she said there was no payment made on July 31 and that if I had a payment issue I had to speak with customer service. She then placed me on hold after several minutes, another woman came on the line took my information and proceeded to tell me I was transferred to an incorrect department and sent me somewhere else.
Next rep stated my problem was I had to make the July payment and then I had to make two loan modification payments before the 15th which would have had me making 3 payments in a 2 month time - that isn't any kind of payment assistance. He transferred me to another rep who stated that wasn't the problem and again said I had short paid by the loan advance. Finally, transferred to another person who stated that from what she could tell I had made both loan modification payments on time and for the correct amounts. However, the manager of that department was out and would have to look into it next week. Three hours after that conversation their collections department called me again demanding the August payment and called me again this morning.

I had a home mortgage loan through HFC, refinanced through American Equity Mortgage. The closing was back in March of 2010. Now HFC says I owe them over $17,000.00. After all that was paid off through the other mortgage company, HFC continues to call and harass me. I had called and tried to talk to a manager and it was like they didn't hear me. I always get someone with a heavy accent and can't seem to speak English well. I don't know if they can't understand me or just harassing! I am at my wits' end. Help me. I had tried to get the company owner's name and no one seemed to know of any such person.

I have been on a mortgage modification for approximately 2 years and applied for a continuation for which I was told that I was approved for a permanent modification and to just keep paying the same amount on time and that I would receive written confirmation in the mail shortly. This was in June. After 2 weeks, I never received any paperwork, and really didn't trust just a phone conversation, so I called to see when the paperwork was coming. At this time, I was told that they were working on my modification request and it wasn't even for sure I was getting approved, to call back. I called back about a week later and was told that I was approved on June 22 but for a higher payment and the paperwork would follow soon. I was told to pay the original amount for July, which I did.
I continued to call weekly and no paperwork. One day, I was told that this would negatively affect my credit since it was reported to the credit agency (which I was never told when I first applied for modification), so I was upset since I had never been late on payments or anything. So I looked into this and found that there was an option approved in November 1999 for them to report it so it wouldn't negatively affect my credit. But when I called back to ask, I was told that they choose to report it as though I am on a payment plan, so it will affect my credit negatively. They also said that if I felt they weren't in compliance with something, I could write to some department (which I have written somewhere). I have been trying to find out if they are in compliance or not, but none seems to be able to help me with this information including your office. I don t know who to call next; consumer affairs, attorney general, HUD housing, etc. I've tried everyone.
Next, I was told that I would have to pay 50 dollars more per month but I was indeed approved at a higher interest rate than before and papers would be sent in a week, still no paperwork. Then it gets even better, my ex-husband filed bankruptcy and they said I will have to apply all over since his name is still on the loan! I told them that he signed a quit claim and has no right to the property, but they said it didn't matter at first, but they, after I insisted it shouldn't affect me, looked into it further and said that since I applied before he filed, I was still approved, and again the paperwork was on its way!
Well, another week and no paperwork, so I called again, this time the woman said that this was a court matter and they take time and I said that I was told that this was approved back in June (it's now the end of July), and I was supposed to get the paperwork. After some time of looking into the situation, she did indeed agree that I was approved and now assures me that it will not negatively affect my credit due to the fact that I have always made timely payments, etc. and that the paperwork had gone out July 21st. But I told her I never received them, so would they please send them overnight them to me? She said that she couldn't promise that and wouldn't give me to a manager, but assured me that all was okay, and that I would be sent the paperwork.
Anyway, it is now August 8 and still no paperwork, and to top it all off, I tried to call in my August mortgage payment and after I put in my account number, they transfer me to a machine that says to call back and talk to someone during their normal business hours which are Eastern time. Mind you and I work full time so their hours aren't the easiest for me. I can't even pay my mortgage over the phone like I always do since I get paid every 2 weeks and don't always have the time to mail it and feel secure it will get there on time. Can someone please help me get this resolved? I would greatly appreciate the information you are able to give me.

On May 16, 2010 our home was damaged by hail as well as a door and gutters on our 24/30 out building. On the 6th of June a claim was filed with State Farm Insurance and on June 20th State Farm adjuster inspected our damage and gave us a check for $12,520.93 which was made out to Diane Morgan & Beneficial. On June the 26th a special packet was received from Beneficial and filled out along with the check plus all requested material was overnighted to Beneficial. Our roof was completed by July 13th and guttering was done by the 15th.It was inspected by Beneficial on the 13th and the guttering was inspected on the 22nd.
Our roof has been completed for 3 weeks and has received no funds from Beneficial to pay our contractor. Each time that we have contacted them, they tell us that they are missing required documents even though we have faxed all required copies at least 4 times. Also, a phone call was made by our State Farm rep. to Beneficial and Beneficial was asked if they had all required documents and they stated that they did. All required documents were received by Beneficial thus completing our part of the requirements. I spoke with a lady name of "Rosy" and she said that they had all documents and would overnight a check for about 90% of completed work.
Today (8-3), Beneficial said that they were only going to send us a partial check for $3000 but according to Beneficial they still are missing 3 documents. Every attempt has been made to settle this claim but Beneficial still is holding on to the check. Also, when the faxed items were sent, Beneficial refused to give us a confirmation number, also refusal to provide a name. Even the Contractor talked to Beneficial and stayed on the line while he faxed the documents to them and they acknowledged receiving them.
Every attempt by us to get the money to the contractor has met with delays, stonewalling, and refusals on their part. We are facing the possibility of having to pay the contractor $12,520.93 + an additional $87.77 for adjustments making the total of $13,608.70 and we can't come up with that kind of money. We are maxed out on everything and it is virtually impossible to come up with that kind of cash. This is totally devastating to us. My wife is facing a mental breakdown plus who knows what else will happen.

My mortgage payment bounced. So, they held the rest of my money for 3 days, then took the highest payment that came in, paid it, and left the little payments to all bounce. Instead of just the one big payment bouncing they only get 35$ for, they pick and chose which one to pay 1st to cause the other ones to bounce causing over 400$ in bank fees.
And are still letting business try to get money out of my account and hit me for bounce check fees every time they do it and told me they where going to drop one or two of the fees but since I threatened to turn them in and tell the local news channel what they did to me she said no way!
Now the bank will take 500$ in bank fees out of my checking account on the 3rd because direct deposit from widowers benefit goes in on the 3rd. My mortgage will bounce again then that will be twice and they will start to foreclose my home. I cannot miss 2 payments but the bank will take their fees first and will make no arrangements with me to pay it back in payments or any other way! I cannot afford that and my mortgage too, so they will get their money anyway they can from poor people.

It all started March 2010. My husband was two month behind and we had some unexpected bills came up. So therefore, we were unable to make the February and March payment at that time when it was due. In the early part of April, we attempted to try and make payment arrangements to try and catch up in but before we could do it, they had already sent out a letter on April 13th, saying that we were behind $1400, which was true. The day after that, we had received a letter from an attorney's office out of Atlanta,GA. stating that they had our loan; it was in foreclosure and we need to pay $3,507.54 as it would be going on the sale block on June 1st 2010. Mind you, we had been talking with HSBC since April. They told us to send in the $1,416.43 certified mail, which we did, and they refused sending the check back. Now, we did all of this in May because we could not get any answers from anyone on what to do in April.
So now, the payments are three months past due and that was the reason they would not accept the $1,416.43 that we were told to send in. Now, in May, going back and forth between HSBC and the attorney's office, we finally come to an amount to send HSBC on May 16th. We send HSBC $2,935.04 money gram and we call them back with a tracking number. My husband then speaks with a Heather ** that says we did not send the right amount and that we are $88.00 short but that was their mistake and they will just add that into our principal balance. My husband, at this point, says okay to whatever get me back on track.
We now asked for a statement to be sent out, and she says that as soon the money is applied, the statement will be sent out. Okay, so we give it a week but still no statement. We're still in May calling there now and doing some type of modification to the loan. We called back a week later, going into June now, and talked with a customer service representative; we're still in the process of foreclosure in June. So I demand to speak with someone high up that can give me some answers. I left message after message for Customer Service Manager, April ** to call me back and called me back on June 22nd, this all took place two weeks before she called me back.
On June 22nd, April ** stated that we sent in too much money $578.37 and that our June and July payment was up to date and come August, we had a credit of $123.37 and we would pay the difference, and all the late fees would be waived for all the trouble. So I say okay, and when do I receive my statement, she says that as soon as the modification is complete, I should receive my statement. I was still confused on how we sent too much money then told a month ago that we were shy $88.00, but again whatever. Just send me something in writing so I received a statement on June 24th 2010 saying that we owe $967.51.
I called April back go to voice mail but she's not in and leave a message after message with no returned phone call till July 7th at 6:30PM. Now, the story is that we sent in too much money now, it's $778.37 and June's payment is current and July we will have a credit of $123.37, and we owe the remaining on July, and reg. payments in August. So I ask how we sent in $778 too much in June it was $578, and we were good till August, now were on good till July.
I was confused. She will get back with me. Well, it is now July 19th, I've been calling all week last week and the voice mail is full and can't leave a message, so I spoke with a Beatrice ** today who is just a customer service representative who tells me that I only owe $166.74, and this will bring everything current and I will be back on schedule with August payment, but it is still in modification. I am still waiting on April ** to call me back.
So my question to everyone who has read this, should my husband and I walk away from this file chapter 13 give them the house, we don't want to do that seeing that this is a family home it was his grandparents home, but we don't have the money for a lawyer, and I know us getting behind on our payments were our fault, but for all the stress and confusion, is it worth it? We feel like we'll never going to get out of this.
We're getting told so many things by so many people, and people who you think can give you the answers don't seem to have them either, all you get told by HSBC is lie after lie. Their record keeping is terrible. Well, as I'm sitting here writing this, guess who calls. It's HSBC wanting me to make a payment of $944.74. What do I do?
In result of all the stress that my husband has, he went to speak with a bankrupt lawyer. I have had emotional breakdowns from being told things that are not being true. It has caused emotional breakdowns as this being our family home and not really wanting to walk away from it. We don't have the means and the credit to rent. The only option would be to move in with family members for a while which wouldn't be so bad but we have small children that added stress. We both feel overwhelmed not knowing which way to turn; if we're doing it right or are we not. Some advice would be nice.

This company took money from our checking account without permission. We had been making one-time only payments online, and we had to use our grace period for the month of June. We had until the 10th of the month to make the payment. They took it on the 4th and over drafted the account by $700.00. My husband had called on 6/4/10 and told them we would be making that payment the following week, but did not give them a specific day. They took the payment out that very day that he called. We did what we were told to do. We called to tell them that our payment would be presented past the normal due date of the 1st.

I had a small loan and good credit but I had a letter, received in the mail, offering $1,500 loan with just by signing the back of the enclosed check (voucher). My need was small and the loan would be just enough to get what I wanted. Little did I know this would start a long process that put me into over $165,000 dollars into debt with them? I felt like, when trying to deal with the face to face, I was playing the games of "Keep away, a Cross Questions and Crooked Answers.” I could get a payment into their office at 3 p.m. to find out the cut odd was twelve noon, even if it was not due until the next Monday. Now it was late. I was told there was no one to process the payment because he or she had left for the day and would not be back until Tuesday. Of course that was so I would not come back in time. This always gave them an extra 17.50% and a penalty fee. Eventually I wanted to pay off the balance and could not because they continued to claim a payment worth of interest had accrued.
I retained an attorney years later who said he had closed loans in the past for them and he would try to get in touch with someone. That never occurred and he suggested I file with the Class Action Suit that was being forms. Again I tried to clear up the balance I owed. Lee, Office Manager at HFC, came in to say I had an outstanding lean with them for $50,000on my loan. I told him I had paid every payment and on time every time. He said just because I had come in on the due date did not mean it was paid on time. I tried mailing a payment two weeks early and it was said to be lost in the mail and there was a penalty and interest due. I went to my bank and secured a pay off at the time the first work of the savings and loan scandal began. There was a class action suits against HFC forming. I secured an attorney who did have not told me he was still in a conflict of interest in the case. He told me of the pending class action suit. I contacted the office of the atty. handling the case. All I received back was $3,000.
Today I continue to pay my bank for the amount of $165,000 in which the full amount of $95,000 was to pay off the HFC loan and the remainder was interest, atty. fees, and bank fees that kept me from losing my, once paid off home. I feel I was screwed over not only by the legal system, HFC, and the US Government for not taking this company to task. There are many stories like mine and there should be an investigation of this company by the US attorney General into the fraud and under handed way they conduct business. I now realize there are people who do not pay their bills, even they should be treated faily.HFC does not know the word Ethical Practice. It is time for action to close the Company completely and not re-open under some other name to continue. Thanks to the hard work, I have an 800 FICA score. My home will never be paid off in my lifetime. I continue to live there.

We had a flood in our house in February 2010. We immediately contacted the Hartford who sent an adjuster and agreed an amount for the claim following two bids from two separate contractors. They agreed to settle a sum of $23000 and sent that check to us which was also made out to HSBC as we have an outstanding mortgage on the property.
We sent the check to HSBC in early March and have not received a penny from them. It is now late May and the house is still uninhabitable and my wife and three children are sleeping in one bedroom at her mother's house.
When I contact them asking what the delay is, they come up with one excuse after another. We have signed and re-sent forms two or three times. They have asked for additional paperwork from contractors, additional bank information, and have generally just been trying to buy time. I'm sick of it and can't carry on any longer. Please tell me what I should do.

I've been trying to get a live person for over 35 minutes. When I finally got one, she was rude and cut me off. I was interested in buying a property. This company is so large and these people can get away with any poor service and no one will ever know who it was. This is a waste of my time.

RE: negligence and fraud by HSBC in return for my faithful payment of my mortgage, on time, and in full every month HSBC Mortgage Co. is interfering with restoration of my home after an insured loss, by HSBCs negligence and fraud. Nationwide, my insurer, included HSBC name on its checks to me for the damage, covered by my home policy. HSBC Mortgage Co. Loss Draft Dept must sign and release the funds for me to pay for work completed, or to pay to get my house fixed after water damage. They have ignored my correspondence. They have also made misleading and fraudulent statements regarding why they have kept the checks and not released the funds for my home. Ex, they wrote listing items they needed to release my funds. In contrast to this fraudulent letter, per phone they demand an entirely different set of documents never mentioned before. This is to confound and delay my efforts to pay for or have work done on the home.
Their phone agents are misleading and obstructive. Today "Donald D", Loss Draft Dept refused to answer my questions regarding why my checks have not been sent to me, to pay a plumber who finished months ago. His replied "I told you to write down what I tell you, I ain't gonna repeat it. I told you write it down." I believe this is abuse and designed to keep my money in their account earning interest.
I informed this individual, that HSBC can be sued for this type of tortuous interference and malfeasance. HSBC and individual employees can not hide behind telephones and their company bureaucracy, they are not outside the reaches of legal process. They are responsible for their behavior as a company and as individuals, and they can be sued as a company and as individual persons. Each encounter with HSBC they create new demands/obstructions. I respond promptly each time, but there is always a different excuse. Last "Adrian B", Loss Draft Dept left a message and no usable number for my response. He apparently has neglected to inform me of the information he needs on my claim, as this information changes and grows with each call. I should have been given a list of items needed at the outset. But this is their game. To delay and obstruct and keep the money in their possession, they forced me to sign over already.
I hope BBB, FTC, and Atty General can assist me. I prefer not to sue HSBC as a company and "Adrian B" and "Donald D" of Loss Draft Dept as individuals, though I am not afraid to do so just because they are out of state and hide behind corporate red tape. HSBC and its individuals must discharge their duties faithfully or suffer legal action for disrupting my home and its restoration. Loss of full use of my home, economic distress, personal distress.

For almost two years, I paid my bills on time every month. My interest rate was over 25% for an unsecured loan. 90-95% of my payments went for interest. When the economy got so bad, my husband's hours were cut and I called HFC and was put on the "hardship program." I was told after 6 months if my situation had not improved it could be extended for another 6 months. Well, I called them back, faxed them exactly what they asked for and followed up every day for the past 3 weeks. Every day I talk to a different rep who tells me something different. I have been told at one point that I was pre-approved, only a day later to be told they needed 3 months of statements. This is after I was initially told one bank statement was sufficient or 2 weeks worth of pay stubs would be fine.
They tried to tell me to begin with that they did not receive my fax. I told them I got confirmation that they did. Then they claimed someone had lumped all my expenses together, which I listed individually. Last but not least they kept asking me what misc. income I had listed. I told them there was no misc. income. That the income I listed was just that: income. The income was what my husband and I brought home each month for working a job. I also told them that they are the hardest people in the world I have ever tried to work with.
The first time I was on the hardship program, they would call me right before my payment was due and tell me that I was so many days behind. I could not get them to explain to me how that was possible since I was going by my statements and making the payment of what my statement said. They told me anything from, "Well, it's just how your statement cycles," to "When you first went on the hardship program, you had a full payment due before the hardship actually got approved." They are nuts who make things up as they go!
I am spending my lunch hour on the phone arguing with these idiots. I literally get so worked up because they make me so mad that my son has actually had to tell me to calm down. It feels like my heart is going to jump out of me every time I deal with them. There is no rhyme and reason and you might as well be beating your head against a wall as trying to talk to them and work something out. It's made me feel hopeless and helpless. I even told a rep the other day that if they did not want to work with me, I might have to look into filing bankruptcy.

In March 2009, my husband and I applied for the hardship program due to his being laid off from General Motors. When we contacted HSBC, we were actually told it was not worth our time because it would take 3-6 months for the paperwork to be reviewed. We said it didn't matter because at that time he had already been laid off 4 different weeks and in March was being laid off indefinitely. Reluctantly, the woman on the other end said, "Okay, we will send the papers out." At that point, we were never told that we couldn't receive help because of our being in a Chapter 13 bankruptcy and that's why our lawyer suggested we apply for the hardship due to the impending layoff. However, the papers never came. So my lawyer told me to call again and ask for the paperwork, which I did. We never received them until May 2009.
In between that time, I tried making a payment only to be told that they wouldn't accept it and that I should call their lawyer. On June 19, 2009, I "overnighted" all the paper \work to HSBC. I have the person's signature, the date and the time when the information was received. We never heard anything back from HSBC about the hardship, nor did our lawyer. I was told to call them once again and see what was going on and was told that they never received the papers. I called my lawyer and she told me to forward them to her and she then would forward them to HSBC attorneys, which she did. None of us ever heard back from them until October when they said I owed $7000 and needed to pay that in 10 days or they would start foreclosure proceeding.
Once again, I called and tried to talk to someone and make a payment only to be told that they couldn't take the money and I needed to contact their attorney. I also asked about the hardship program and they told me they had no record of us applying so again, I told them to send the paperwork. They told me to contact Novadebt, which we did. Novadebt contacted them; we did a three-way call. The lady at HSBC told them, "Yes, we could do the hardship" and we needed the paperwork done, so we told them to send it out. They never did. That was attempt number 3.
Present day, we still know nothing about our home. Our attorney had tried several times to contact their lawyer and nobody calls her back (this is of March 3, 2010). We were discharged from our bankruptcy in January 2010 and have just received our very 1st billing statement form HSBC on February 22, 2010 (which was due by March 16, 2010 in the amount of $16, 424). We have had HSBC since 2003 and have never received any paperwork or anything when they became our bank other than a booklet with the account number and a phone number for them. They purchased our loan from another bank which is how they became our present mortgager. We didn't even know the actual balance on our home until this year when we received this current billing statement.
When they purchased our loan, they also omitted my name off the loan for whatever reason and also we come to find out someone put my husband's name on our deed. It was land owned by me and only had my name on it since before us building our house. They raised our interest rate three times, which we were told that they could not do while we were in a bankruptcy. Our payment started at $937 and ended up at $1335. They also didn't apply our payments to our loan 4+times and then would call us saying that we never made a payment and were in default when in fact, they had withdrawn the money from our account and never applied it to our mortgage. They did this so often that when we would make our monthly, sometimes, the payment was around $900, when it should have been $1335, almost like someone wasn't calculating correctly.
Our interest rate hadn't changed and we only made the monthly minimum payment the months before, so how on earth could it have gone down that far. Oh, they would say, as if to be surprised, and lo and behold, they were holding the money elsewhere, for whatever reason, but never crediting full payments to our account. It makes zero sense why they would do that, because we never knew anything about an escrow account, because during this time, our taxes or insurance were not paid through them. We paid for that separately. (This is why I have never mailed a payment fearing that they would say they never received it.)
On March 3, 2010, after talking to my attorney, I called to see what was going on. I talked to three different people, all of whom gave me different information each time. I was told that unless I make the full $16,000 payment they would not accept anything from us. The 3rd person that I talked to actually said there was no record at all of us ever trying to apply for a hardship in 2009, which as I said before was actually 3 times, and "you will be our 5th". She went on to say that they can only go by this year's pay/income, not last year's. If that is the case, then they will clearly deny us because of my husband not getting laid off until the week of March 1 and the week of March 8.
As of 4-27-2010, we found out through the local newspaper that HSBC had filed foreclosure proceedings on our property as Household Realty Corporation on 4-23-2010. We have no clue who that is, because according to my current statement it's HSBC Mortgage Services not Household Realty Corp. And, as of today, we haven,t been served anything from the local court nor has HSBC sent us anything, only a billing statement.
There have also been major discrepancies as far as to what and how much our payments should be, because our payment was $937 and went to $1335 and back down to $1114 (which is what it is now). This all happened in the last 5 years. Our payment fluctuates every month and from April 2007 to March 2009, we paid well over $40,000. Now if you add all this up since they have become our lender, even when we were paying $937 and then $1335, to present we have paid approx. $86,000.
The loan that HSBC purchased was, according to my paperwork from Regions Bank, which granted could be incorrect but even so, if we have been paying all that kind of money our loan would technically be in the 60s without the fact of interest and finance charges, of course. But, it does make a person go "Hmm" and we never got extra money so if in fact, the account closed and paid on my credit report is Regions Bank dba American Home Mortgage, that loan balance was only at $143,100. How is it now that I have paid $86,000 to HSBC and my balance is now $143,600? Oh, and yes, we do have an arm loan with an APR of 11% but to our understanding the APR laws of ARM loans can only go up 1 point or down 1 point every 6 months. I would have to say that $400 is more than 1 point in less than two years; how is that?
I have called Jim ** at the Attorney Generals office, our State Representative Charlie Wilson, and Save the Dream Ohio and they in turn have told me to contact ESOP and NDS from Ravenna, which I am currently doing. I am also in contact with Community Action, all of which was suggested to do by our attorney.We don't want to not make a payment nor do we want to lose our home (I am the 3rd generation to own this land). We just need someone to help us. Something isn't right and something truly needs to be done.

My husband and I have an account with HFC-Beneficial that we are trying to close, but all this month we have been given the runaround. Our loan officer has sent in a borrower's certification to get a 12-month payment history. It was faxed in 12 times this month. I also faxed a letter myself on 4/22/10. So far, we have not gotten this information. If this is not handled by tomorrow, we will be filing complaints with the BBB and the Office of Theft Supervision. Because of the many requests for this information, you are already over the 10-day limit.

We refinanced with HFC in July of 2008, after being directed to them through Lending Tree.Com. We finalized our refinance agreement with company representatives in Lincoln, NE. We were told we could refinance with them after a year, as our initial interest rate was higher than normal (10.99%) due to our credit rating.
In the fall (October/November) of 2009, we called HFC to restructure our loan (From 15 year to 30 year) as the payments were becoming a financial challenge. I contacted company representatives on at least two separate occasions, asking to refinance our loan. I was told by representatives that HFC had closed and they could only accept loan payments. I was informed that they would not refinance our loan, nor would they restructure it in any way. This forced us to look elsewhere for refinancing. We found and secured refinancing through a local bank, but were forced to wait, as our appraisal dropped by $20,000 since the refinance with with HFC as a result of poor local economy.
As of April 2010, we have utilized personal property (vehicles) to obtain a second loan for the discrepancy in appraised value, to make up the deficit in closing costs.We were due to close on our loan on Monday, April 26th. On Friday, April 23rd, our loan officer contacted me, advising HFC tacked on an additional $5000 pre-payment penalty to pay off our existing loan with their company.
The original agreement had provisions within that stated we would be subject to a pre-payment penalty if we refinanced with a company other than HFC within a two year period after our loan origination date.
My wife contacted HFC immediately, asking them to waive the penalty and spoke to Doreen. Doreen would not wave the penalty and would not transfer her to a supervisor, after numerous requests to do so. Doreen informed my wife that she could submit a written request (to a fax number that did not exist). This request was supposedly for the company's "research department" and my wife was told she could expect a response back in 7 to 10 days.
I phoned HFC as this was an unacceptable arrangement, paired with a false fax number. I spoke with Maria, who was unable to answer my questions and refused to transfer me to a supervisor. Maria provided a second fax number for a department she said, could not be contacted by phone. Maria advised I should put "Emergency" on the fax to receive immediate response from that department. As of 4/25/2010, I have not yet heard back from that department.
I phoned back 4 1/2 hours later, after not hearing back. I now spoke with Marcus, advising him their company was in breach of contract by not allowing us to refinance with them and then penalizing us for going elsewhere. Marcus also advised he could not waive the penalty fee. I informed Marcus that I wanted to speak with a supervisor and refused to take no for an answer.
I was then transferred to Ben, who said he was a supervisor. Different person, same result. I again demanded to speak with a supervisor as they had violated our contract. I was told no, but did not take that for an answer and was subsequently transferred to Dion, who advised he was a supervisor.
I eventually got Dion to admit HFC had violated our contract. Dion added that the rest of the contract still applied though. I advised Dion the portion of the contract they violated should negate at least that portion of the contract. This would include waiving the pre-payment penalty. Dion agreed it should negate that portion, but advised the remainder of the contract would still require the pre-payment penalty. We continued to argue in circles around the same point. Dion would admit that part of the contract had been violated, but would not waive the fee. I again demanded to speak with a supervisor. Dion advised he would have his supervisor contact me in 24-48 hours. This occurred at 1450 hours(MDT) on 04/23/2010. As of 1615 hours on 04/25/2010, I have yet to hear from any HFC representatives. Approximately $6000, and possibly more when all is said and done.

In 2008 my husband's real estate development co.went under quickly after housing crash. We lost all income & plus. We had been long time HFC customers. We lived off our relatives (losing home to BOFA) till 6/2009 when he finally got job out of state about 60% less but had health insurance (we have 4 children). We could not pay them till then. We used a debt management co. (Care One Credit) just to stop the harassment of collections. We came up with a plan hoping HFC would freeze the interest rate or at least cut it until we could catch up; the balance at that time was $11549.15.
As of today, after paying 10 months of $90 payments (that's what we could afford), $900 total, the balance (HFC says) is $13,173.48! They are charging 18%. They won't help at all. I am trying so hard. But it has gone up over $2000. I just threw away $900. They need to be fined. We were excellent customers for years until this horrible, humiliating, spirit-crushing financial experience. We can't be the only ones in this position. We are trying to get back to some kind of normal life but we can't with blood sucking greedy companies like this. I am not paying them anymore, I give up. I am already depressed, have high blood pressure and anxiety due to this recession and HFC does not help. Thanks for listening.

I normally make my payments to HFC for a HELOC that I have them online with direct debit to my checking account. In January of 2010 HFC (HSBC) decided to debit my account for two payments, instead of one. I quickly stopped payment on one of the debits and called them to resolve the situation. They denied it even happened until I faxed proof. After numerous phone calls I finally talked to someone in the United States and was told it would be resolved shortly. I was also told that my account would be frozen until it is resolved That was 90 days ago.
My account became "unfrozen" and I am now being accused of bouncing checks on them and they will no longer allow me to make payments online. My phone rings off the hook and I am called a liar when I try to explain the situation. They have not given me credit for the payment that they did keep in January even though they have been given reference and tracing numbers. I have been told that I will not receive credit for my January payment now because it has been too long to be resolved. In my opinion this is theft, but no one seems to want to do anything about it in New York state.

I have a personal line of credit with HFC since 2005, which started with a balance of $7,000.00 at 28.90%.I have always paid on time and never missed a payment. As of April 09, my balance is $6,849.90. I called customer service and asked for a lower interest rate and was told they can do it but they would report it to the CBR and ruin my credit.
I explained I'm a good customer and was paying too much interest. My balance was not going down after 5yrs. They advise nothing they could do but ruin my credit for taking the lower rate. I feel I worked too hard to maintain my good credit and felt it was not right for them to give me this difficult choice which can prevent me in the future from buying another house.
HFC are a bunch of loan sharks. All I want is a lower rate. Just last year alone, I paid $2,059.15 in interest. That’s ridiculous. If there is anyone who can help I would appreciate it. Thank you.

I tried to just refinance my existing loan with them. They said they are not doing that but they are taking new loans. I just wanted to get a fixed rate loan at a lower rate, they just raised my payment $100.00 with this variable rate loan. If they would change it, it would lower my payment $300.00, but they won't. I went to do a loan mod and I have been getting the run-a-round for 6 months. With my wife's medical expenses, I have fallen behind. The last payment I sent in, they sent back. Now, I have to file bankruptcy.
I owe $198,000, 10 months ago it appraised for $193,000, so they would not refinance. Now it appraises for $117,500. They are starting the bids at $78,000. They would rather sell the house at a $100,000 loss then to do my loan and make money. With me filing bankruptcy will stop the foreclosure. I would think that there are a lot of people out there that some way, a class action lawsuit would do something to help a lot of people. If you could send a response to my email, that would be great.

I tried to refinance my house to lower my interest rate and when I spoke to a representative, they inform me in the state of Florida that they are not doing any refinance. I was mad because when I first refinance my house my interest rate was lower. Then in October 2008 I refinance again and my interest rate was higher, and when I asked for an explanation they told me that since my husband credit was not good, that's why the interest went up. I did not believe that. It just did not make any sense at all.
I found another mortgage company and I was going to refinance with them. My credit was good and it was several items that they needed from HSBC. When I called trying to get the information I spoke to several different people that did not speak English well and when I asked them for the items they did not know what I was talking about. I gave them my fax number to fax over the paper work. You would not believe what they fax me—copies of my appraisal and they tied up my fax machine that when I called them back the next day they told me that they would stop. But the next day I think I receive the appraisal report about 5 times. I was so upset with them. Long story short, I did not refinance my house because I was told that the appraisal value for my house was low. I feel that HSBC is a rip off and that I hope that they get what's coming to them.

I got a loan with HFC. I was told I could pay on the principal. Almost three years later, I still owe the same as the original loan. I have been making more than agreed payments and I have been charged deferred interest. My payment is $496 a month. I paid $785 of that. $410.92 went to interest and my deferred interest went up only $374.08 went to the principal. At this rate, I will never be able to pay off my home. The stress from this causes me to not be able to sleep and all the money that seems to be just gone is lowering my standard of living.

I used to have a 1st and 2nd mortgage with HSBC for a home I owned. We did a short sale of the home in April of 2007, which HSBC agreed upon and approved and the home was sold. Two months later, I received the first of many calls from HSBC sating I still owed the remaining balance. I first started to pay them $50 a month, then I reduced due to other financial issues. After I started to get more calls from HSBC asking me to make a settlement payment, I started to question why I even have the debt when I did a short sale.
They said it's because at closing, I agreed to pay the remaining balance, which is untrue. So every month, we have this back and forth call about do I really owe, and on talking with others who have gone through short sales, and with mortgage professions as well, no one has ever seen where a remaining balance has ever been owed after a short sale was approved. I have tried disputing this through the credit reporting agencies, but HSBC responds back to them that the accounts are accurate and active, so they will not remove them from my credit report. So as I have become more and more educated on this process, I have learned that I have the right to file complaints and possibly sue HSBC to remove anything negatively effecting my credit and to have them honor the short sale agreement which they approved prior to closing the home. So I am reaching out to you for help and guidance on this issue.

This company has not done their job. Sent my 1098 form since the end of January 10. I have been calling them every two weeks regarding this property tax form all this time, and there’s still no information. I am requesting from the company. I am just tired of playing phone tag, waiting for the form. I have headaches calling the company every time.

I am in the hospital due to heart problems. My home had a sale date posted for March 4, 2010. I had surgery on March 3, 2010 to assist with the problems that I am having. Please note that am dying and there is not much that the doctors will be able to do. I have terminal cancer at this time and the odds do not look good. I tried contacting the bank in regards to my condition and for assistance with the postponement of my sale date. They would not do anything for me even after the explanation of my situation.
The next morning I left the hospital to go to the local court house so I could file for emergency bankruptcy. That way I could stop the sale date, just to give my husband and I more time to prove and work with the bank in order to keep our home. I left the hospital against doctor's orders in order to do this. I showed up to the court house with machines and wires attached to me. This shows how much I care and love my home and want to keep it so that my family will be able to remember me and all of the wonderful memories of their mommy and wife that is in that home.
My husband was unable to go to the court house for me due to the fact that my husband is unable to miss anymore work due to my illness and also the main fact is that is our income at this time. That is the money that we feed our children with. Being as sick as I am, I have had plenty of time to do research on all of the government programs and what the lenders really do.
By doing all of my research I have read stories that the lenders do not want to assist their borrowers that have terminally ill borrowers due to the fact that the loan will become a non-performing loan once after I have passed away. I understand the mentality behind that way of thinking; I am leaving this earth with a family behind. I will not be able to leave this earth with peace knowing that my family will have nowhere to go or into another home that will have no memories of us as a family together. That is why my husband and I have worked so hard over these years to make sure that we will always have a home for our kids and grand kids. I understand that to these big lenders all they care about is money.
But they need to understand that this is not just a piece of property, it is a home filled with memories and love. Programs were emplaced to assist homeowners that are having financial difficulty in paying their monthly mortgage payments. Please assist me and my family to keep our home. Please do not penalize my family because I am dying. I would like to have a payment that my husband will be able to make after I die so that he and our wonderful kids do not just lose their mother but their home with so many memories are filled.

They took over my mortgage loan in October of 2006. They are very much a company that practices predatory lending. I have tried to get refinanced and of course they have my house upside down. No other bank will touch me. I have read through other reports on here. How can a company get away with what they do? They prey on individuals that need help and make it sound good and they really put the hurt on them. I would love to have their practices investigated. I am trying to go through a refinance with them and I don't know the answer yet but if they can't help, I will have to foreclose on my house.

HFC charged insurance for property in Florida that does not exist to my account and took it out of my checking account. I have been trying for over a year to get the money refunded to my checking account. Everyone I speak with gave me a runaround. Please help. They owe me $590.00.

It started on June 2008. I was already late on two payments. I called to see what we could do and they said that we could try applying for a loan modification. I filled out the information and faxed over as they requested. A couple of weeks later, I got a letter stating that they regret to inform us that they will not be able to approve the modification. I then called them to ask why and they said because of our finances. I could not figure out how they figured because when I did the financial form, I was at a negative $600.00. The customer service representative who I was with on the phone went over my finances, the same ones that I sent in, and said, “Oh you, I can see why you are struggling. You do not make enough money.” So she said that she would send it in for approval again.
Weeks went by but I heard nothing. Then I called again and the customer service person said that they had nothing on file stating that I was trying for a new modification. So again, I had to go over all my financial stuff again with a different person. I received another letter a couple of weeks later stating that they regret to inform me that we were not approved for a modification. So this time, I decided to go to HUD. I went and talked to a counselor and showed them all the paper work that I sent HSBC and the letters that I got from them. I went over all my financial stuff with them and they ended up sending it in to HSBC.
I finally got a letter from them weeks later saying that we were approved for a modification for 5.25% for 6 months. I made the first payment on time then my car broke down and I had to use half my mortgage to fix it so I was late. I did call them to let them know and said that as long as I had all 6 months of payments in, they would honor my modification for another 18 months. I made the last 3 payment arrangements with them and borrowed money from my husband’s $401,000 to pay the mortgage up to date.
Two days before I was supposed to make my last payment, they stated that I had to pay the original interest rate of 10%. I told them that I already made payment arrangements with somebody else and it was agreed that I pay the 5.25%. He said that is why he was calling me then to let me know that before I make my payment, that I have to send in another $800.00. Well, where the hell do they expect me to find that much money in two days? So because I couldn't pay that full amount they cancelled my modification.
My ARM changes in January. So in December, I got a letter stating that my interest rate changed from 10% to 7.68% which I still cannot afford. So I called them and they stated that I could reapply for a loan modification. So again, I sent in all the paperwork. In the meantime, I asked if I could have a restructure on my loan so that I would be current and start afresh. It took about 4 times of me talking to different representatives before one of them actually put it in the system. Then I got a phone call stating that I was approved for a modification.
My new interest rate would be 8.68%. I had to laugh at the guy. I asked him how a modification can be a higher interest rate than my regular interest rate. I told him that I did not except that modification, not to put it through and then I got my bill in the mail. I almost had a heart attack. My bill came in at $3,300. What the heck is that? They did a restructure on my loan and still charged me for a late charge and interest rate for the missed payments and they kept my interest rate at 8.68%.
I don't know what to do. I have been sending them what I can afford because I don't know what to do. My house is 80 grand upside down. My husband and I were suckered into this loan saying that we could refinance to a fixed loan in two years. Then the market crashed and we are so screwed. The people at HSBC sound like they are reading a script when they are talking to you. You ask them a question and they don't know how to answer it. You ask to speak to a manager and they say they are not available. I don't understand how this company can get away with everything that they are doing. Why somebody can’t step in and say, look enough is enough. You are to change everybody who has an arm to a fixed rate and what the interest rate is right now. Not 4% higher. Obama, why haven't I seen any help? You promised.

We lost our home in June 2008, due to storm damage. The insurance company paid the claim, and the money was then sent to HFC loss draft, because we still had a mortgage on our home. We started to rebuild our home, and HFC issued a check for 30% to get started, then another check for 60%, and then another check for 90%. We had to have HFC loss draft send an inspector out each time, before a check was sent to make sure we were at the percentage of completion.
Once we hit 90% complete, we had our home appraised, and it was appraised at almost twice what our current mortgage loan was. This meant that the HFC was more than covered on our mortgage loan. However, they are not willing to release the last 10% for us to finish our home. They want us to come up with $20,000.00 on our own to finish it, and then they say they will reimburse us. This is absolutely absurd. We have been out of our home for almost two years, and have had to make our mortgage payment, and a rental house payment. We do not have $20,000.00 to pay for the carpet and cabinets, and wait for them to reimburse us.
They sent out their inspector on February 07, 2010, and the inspector stated that we were at 99% complete. I spoke to HFC loss draft department today, February 23, 2010, and they still will not release our last check, so that we can move into our home. They are holding us hostage from our home. They will not release the money, so we can finish the home, and move in, and yet they expect us to continue to make our mortgage payment on a home they are keeping us out of. We have made every one of our payments for the last two years, that we have not been able to live in the home. And of course, HFC Loss Draft collected the interest on our insurance money while it sat in escrow.
I think these type of practices should be illegal. I am the one that paid my premiums on the insurance money, that they are collected interest on, and keeping me from completing my home, which the money was to be used for. I don't understand how in this country, a business like HFC Loss Draft is able to do this to people. Because they will not release our money, we are going to be forced to walk away from our home, and have our credit ruined, because we can no longer continue to pay our mortgage, and a rental house payment. We are going to lose our home. We can not financially continue to make our mortgage payment for a home that they will not allow us to complete and move into, and make a rental house payment. This is going to be devastating for our family. We have been dealing with this for almost two years, and now it all comes down to them winning anyway, because they will not release our money.

I took a home equity line of credit in the amount of $31,200. For the first ten years, it was interest only. And now, my payments have ballooned, and I am unable to make the payment. I have requested a loan modification three times, though my bank statements clearing indicates that I have a negative cash flow.
My husband is unemployed, and I do not know what to do. I have been told to file bankruptcy which I really do not want to do. I have put my credit cards in CCCS, and the other companies have worked with me to put me on a hardship payment plan. I need help and do not know what to do. My credit has been ruined, and I am delinquent on my HSBC account.

I was sent a letter from the mortgage company stating that they needed the declarations page for insurance. I called for that from the insurance company and found out that the policy was only in my ex husband name. Being that he no longer live here, I need to get a policy in my name. So, we closed out the policy in his name with him on the phone and opened a new one in my name.
After doing all of those, the insurance company sent the information to HSBC for payment. HSBC sent a payment to the insurance company under the old policy number and because the policy was closed the check was being sent to my ex husband. He may or may not give me the check as it was a bungle divorce. HSBC has not been taking care of the problem. I contacted them the first week of January 2010 and it was a week late and all. They can take more money out of my escrow and pay it again, that is not fair to me to pay twice.

Well they took out our payment without our consent on Dec. 4th then turned around and took it out on Dec. 11th. This was without our consent and even admitted it. Yes, I am behind on my mort. But they stole money out of my checking account without permission. Here it is, Dec. 28th, after they crushed our Christmas. My daughter suffered because my bank account was in the negative. They kept promising they will take care of our bank account but haven't we talked to this so-called manager and he's nothing but a liar? He told us he was sending out a check to take care of our bank account. We would have it the next day. Now here it is Dec. 28th and still nothing. His name is Mr. **, who is a liar. I just don't know what else to do; the bank is backing us. This company should have to pay for what they have caused me and my family.
My daughter had a small Christmas, which made me feel like crap. I had to open a new bank account and everyday, my old bank account keeps getting charged money for NSF funds. This is going against me and my husband. Something needs to be done with this company. I will never pay them over the phone because they will steal from you and admit they were wrong but do nothing to help.

HSBC caused and issue that could cost me my home if I do not find away to get them to correct their mistake and clear my record and name. I spoke to one of their own employees who told me that they made the mistake and he told me how they need to fix it. I told them what he told me and they still will not fix it. They expect me to pay them money I do not owe them to make the problem go away. I have refused to pay them money; I do not owe them.
I have insisted on speaking to someone in management and they refuse to allow me to do so. They say they can't fix the problem so I ask to speak to someone who can and they refused. I ask them their name. I get only a first name so when I call back and ask for them or mention their name, the person on the phone has no idea who I am talking about and say they are a big company. They always promise to call back and do not. The only one that has called back was the one who called back to tell me that someone at their company messed up.
I was finally given two names of two possible supervisors who were supposed to call me back on this matter last Friday. But that call never came and I was told they did not have a direct phone line I could call them on if they did not call me, yet the letters keep coming. It all started with checks I was getting from my insurance company to repair my home from Hurricane Ike damage. The checks were written in the mortgage company and my name. HSBC told me I was to send all checks to them so they can make the payments to the contractors I had making the repairs. That way they can track how the money is being spent.
This worked out until two checks I sent to them, they say were lost in the mail. After nearly two months had passed, they said they had not received them. The rep told me to call the insurance company (USAA) and have them stop payment on the lost check and have them reissue a new one, which USAA did as I requested. One of the checks was a check being sent to me by HSBC. I told them I would be sending it back to them. They said they would put a stop payment on their check which I did not sign. HSBC received the new check and posted it towards my repairs. The rep from HSBC told me two or three weeks later the lost checks were found and someone tried to post these canceled checks to my account, which they were not supposed to do.
Neither check cleared, so someone at HSBC went into my mortgage account which had nothing to do with the IKE money and took money out of my mortgage which I had already paid causing my mortgage to look as though it is three months behind even though I have never missed a payment since I have been with them. This they have admitted too. Bottom line is, had they not tried to post the two canceled checks and taken money away from my mortgage to cover them, I would not be in the mess I am in. A big problem with them is I never get to speak with the same person and first thing they tell me is I owe them money, and all they want is for me to pay them to make the problem go away. I try to tell them what their own rep I spoke with when all of this started. He told me that it's their fault and none of them will listen.
Please tell me where I can go to get help with this. The longer this drags out, the worst it is getting. I have not stopped making my payments but now I am all ways three months behind. The next letter could cost me my home. I have sent two certified letters and no one has responded to them. Consequences: stress and depression.

HFC has executed on my checking account and is taking every penny I have. They will not negotiate nor will they do anything but say it isn't personal. They keep adding fees so that a $12,000 loan is now at almost $16,000. I have tried and tried to pay but they want a large lump sum. They don't care that we won't have any food or money for the next two weeks and they will probably take my money then again. I don't know what to do. I have no money for food, utilities, anything and I am sure that my car payment will bounce. All I asked for was to be allowed to keep some money that I would live. I believe that HFC would have worked with me but the person, Lynnda **, from the attorney's office is the one that won't budge. I need help!

Back on April 7th 2009, I had been approved for a loan modification by HSBC. I was told to send in $1531.24 commencing with my April payment; so I did. I also sent the same amount for May & June 2009. Then around the end of May, I started getting phone calls stating I was delinquent in my payments. I advised them that I was not, I had a loan mod; they said I did not.
On May 26th, I spoke to Mr. ** in the modification dept, only to find out that yes, I had been approved for the loan modification but later declined by a second quality control team. Mr. ** was able to finally get me approved for the loan modification, but by now the damage had been done to my credit. HSBC has been reporting me late for 5 consecutive months, from April to now. The reason they gave me was that they have been taking $189.00 from each of my payments and applying it to the previous month. I never got a letter stating I had been declined for the loan mod the first time around. I've been sending in my payments as I had been instructed, and have never been late on my mortgage since I've been with HSBC.
This error was not of my doing, and HSBC should have never reported derogatory information on me. Now my credit is completely ruined, and I can't even apply for a refi, because of a mistake they made.

The HSBC representative Joann ** called me on 5/20/09. She was very nice and kept me on the phone for a long time, making arrangements as she spoke to her manager (so she says) to get a hardship for six months approved. Joann stated if I paid $392.00 on May 31, 2009 and June 30, 2009, in which I did authorize them to deduct the above amount from my checking account for May and June, I would be set up on a six-month hardship program an to pay $187.00/month from July to December and my account would be current. My interest rate would go down from 22.9% to 6%. They did not take $187.00 from my account in July 2009.
Several representatives called me and told me I was two months behind and need to pay $736.00. I told them about the six-month hardship arrangement and they knew nothing about the arrangement and said they have nothing in their notes regarding a six-month hardship. I was lied to. HFC do not care about their customers. I'm tired of repeating the same conversation to their representatives. Each time you call them, you get a different representative. I'm just dismayed and frustrated with the lies. I want my account current. It is very draining and overwhelming when they tell you they will contact your job if arrangements can't be made.

This all started in February 2009. I was not able to refinance my home because the house was appraised for $40,000 less than what I owe. I then asked where I can find help. HSBC said that there is a program that can help me which the president approved. I called the loan modification department and they sent me a package for hardship. I sent all the information to them in February and in March, they said I was not approved because I was not late with my payments. Then, in April, when the president approved for a different modification, I submitted my paper work again and was told that I was approved. As of June, I will be paying $400 less starting June 1, 2009. I will be receiving a package where I have to sign and return with the agreement for three months. After the three months, they will revisit my paper work to see how I am doing with the payment in case there may be a need to make changes.
Every week, I spoke to HSBC. They stated that they sent me out the form which was never received in June 2009. They said that l need to send a new package because they needed to send to another department the same information that they already had. But they would not be able to submit those papers again in June. I faxed them all the information they requested and even mailed it to them. Now, they said I was approved and once again, I am waiting for the papers which I still have not received. They claim that on September 2009, my payment will be $400 less. But when I called them in the beginning of August, they stated that I will receive the papers to sign. On August 12, 2009, I did receive a package but this is for me to prove again my hardship.
When I called them today, they stated that they are working with my package as of August 10, 2009. I would have to pay the high mortgage again because they will not be able to submit it for September payment. If there is anyone out there that can help me with this problem, please help me. I have worked so hard to keep my home and I have no one left to borrow money from to make this payment.

This has to do with a mortgage that we took out with HFC which in turn ended up with Beneficial. We had taken the original mortgage out in 2002. In October 2008, because of medical reasons within my family, my husband and I had no alternative but to file bankruptcy which we did. We wanted to reaffirm our house so we filled out an agreement, sent it back to the attorney, and the attorney faxed this and sent it also by FedEx. This was sent on May 15, 2009. Beneficial failed to file this document with the bankruptcy court and our debt was discharged on June 9, 2009. When we filed bankruptcy, the financial institution (credit union), sent us a letter stating we were no longer welcome and needed to take our money out.
I always had a direct pay so the mortgage payment came out of our checking out. At that time, I called Beneficial to let them know and to set up the same arrangement with our new bank. At that time they told me because we were in bankruptcy, we could not make payments. Therefore, I contacted Beneficial when our discharge was done and they informed me that this agreement had never been filed and they could not take my payments.
Tiffany said I needed to have my attorney make a motion to re-open the case so they could reaffirm this. As of this writing, it still has not been resolved. I called last week and Tiffany said they still haven't filed the agreement and that I was $4,000 behind in payments, which I have tried to pay them to no avail. I am not getting any cooperation and I do not want to lose my house. This is very frustrating to me and I do not know which way to proceed. Can you please help me resolve this issue?

After repeatedly contacting them for over four months now and submitting my information by fax over 12 times, I still have mixed answers for a loan modification extension after losing a job. Their customer service is a joke and after trying to refi last year and having HSBC threaten me with a 6% pre-payment penalty on a 14.3% rate loan, I was unable to leave them. Now, our LTV has bottomed out. HSBC doesn't offer any refi options and I'm barely working and they continue to give us the runaround.
This group use predatory lending practices and unethical treatment of their customers. They certainly offer no options to anyone in trouble and at the very least if you can't offer financing options right now, could you at least give a straight forward answer in a timely manner? I couldn't even begin to say enough bad things about this group!

I applied for a mortgage with HSBC bank 2 months ago. When speaking to the sales agent, I explained that I lived in Dubai, which to them was not a problem. She said the system rejected me, because I am not on the voting register. But as that was explained by me living in Dubai, she was allowed to bypass this. She confirmed, sent me the forms to fill out, and post off.
My offer for the house was accepted, pending funding confirmation. I spent a lot of money getting the paperwork together, only to be phoned and told I never should have been allowed to apply as I had a poor credit rating. I explained that the bank knew this before I applied, as I live overseas. They told me it's not their problem. I then contacted Equifax to get my credit report, only to find I could not get it, unless I used my mother's address. But to confirm this, I would need to submit a bill with my name on it.
I explained again that I live overseas. I was told Equifax only deal with UK, to which I responded, "Well, I don't live in the UK, but you're happy to sell my information to others, listing me as a bad risk." To cut a long story short, I provided all details of my bank accounts, credit cards, etc., to which they have done nothing; and I still rate as a bad risk, because I don't appear on the voting register. And they couldn't be bothered to follow up on my banks and credit history.
I have never had a debt in my life, and now, these companies are free to sell my information, listing me as a bad risk, because they couldn't be bothered to do their homework. If they are going to be allowed to provide credit information to lenders at a price, they should be held liable for mis-information. They do not list that I live overseas, they do not list credit cards I have in the Republic of Ireland, and they do not list bank accounts I have in northern Ireland, all because the banks I use don't share that information with them. These companies should be stopped.

I have two mortgages. The small one is with HSBC. Due this bad economic situation, I couldn't make payments at that time and I was behind for several months. On July 9th, I called to HSBC customer care phone number, exactly as appeared on my bill. This lady Emily ** answered. I explained to her my situation and I wanted to start making payment trying to bring my account current in less time as possible. In my bill, my payment due was for $1,436.72 but she said that was wrong, my real due was for $2,236.72. I told her, we were looking at different accounts because how could that be possible that we are talking about $800.00 more, why?
At that time, she gave me an answer but she said you can make a payment today and I can review your account later. I agreed because that was the reason of my call, make payments and get some kind of agreement. She took my payment by phone, and she told me to call later to let me know about this difference, I said okay. Surprise for me, when a few days later, I received a letter from this Tate & Kirlin Associates (2810 Southampton Road, Philadelphia, PA 19154, 267-407-0101) debt collection company, telling me the payment I made on July 9th will be processed and reminded me the date of my next payment. At that moment, I said who the heck is that people. So, I called again to HSBC customer service to try to get an explanation. It made me mad because until that moment, I realized that I never talked to any customer service representative from HSBC. Due the status of my account, they transferred my call direct and without my knowledge to this Collection Lawyer’s office. As you can see, this Emily **, who answered my call and I spoke works there and never told me nothing about it. So all this time, I thought I was talking with some HBSC agent.
After I tried and tried and laid about the reason of my call, finally, I could speak with someone on HSBC and as soon as I got her on line, I told her the real reason of my call. I had one modification loan. They told me that modification was cancelled because I didn't make more payments, but again I never was informed about it. Even in my recent bill dated July 01, 2009, you can see the payment due for $1,436.72. I am still not happy with the answer they gave me, made me feel like I was set up for this HSBC Mortgage Company acting behind my back and not letting the people know about what was going on.

In February 2006, I took what I believed to be a $10,000 personal loan out with Household Finance Corp/HSBC by meeting with a loan specialist at their Manchester, CT store. The loan rep indicated to me that this was a personal loan. However, I relied on his word and did not read the fine print. I'll admit that was my first mistake. I have made 41 payments of $207 per month on time every month since March 2006. I have paid a total of $8,487 to HFC/HSBC, yet somehow, I still owe a total of approximately $9,700 on this loan.
What they duped me into signing was a personal line of credit for $10,000 at 19.80% interest. Not to mention that they have been charging me over $28/month for life and disability insurance. I have contacted them several times to cancel the insurances, but these thieves have never cancelled the insurances (until today when I called screaming, swearing, and yelling at everyone I could speak to). They refused to credit my account for any of the insurance payments. I feel as if HFC/HSBC has raped me and will continue to do so on a monthly basis. Therefore, I have cancelled my automatic payments and am refusing to pay them any more money, even if it means I must file bankruptcy to discharge this debt.
What they have done to me is unbelievable, totally unfair, and should be illegal. I don't know how these so-called people can sleep at night. I will never do business with HFC, HSBC, or any of their affiliates again. I plan to spread the word to every single person I come in contact with, and I hope they and all of their entities go bankrupt. I hope more and more people refuse to pay them any more. Their business practices are not only unfair, but these will be illegal when Obama's new credit laws go into effect.
However, that does nothing to help me or all the other people that HFC/HSBC has ripped off, robbed blind, and raped over the years. Excuse my language and the use of the word rape. I mean no disrespect to anybody who has ever actually been raped. It's just that that is how I basically feel about having paid over $8k on a $10k loan and still owe nearly $10k, especially in this economy. Nobody who I have ever spoken with at HFC/HSBC has ever given me an explanation that made any sense as to why my principal balance is still so high. I have several times requested an audit of my account, a written explanation, or an accounting of how I could still possibly owe so much money. To date, I have received nothing from them, but monthly bills.

First of all, my loan with them is under my married name. I have gone back to my maiden name. I filed chapter 13 bankruptcy and was discharged December 2008. A letter dated June 8, 2009 and postmarked June 30, 2009 and July 1, 2009 arrived at my mailbox on July 6, 2009. It was stating that I owed a tax to the City of Lewisburg for over $30. Well, I proceeded to call the toll-free number on the letter; they were closed. I don't get off from work until 5 p.m. CST and mail comes in the afternoon.
Anyway, the next day at work, I kept trying numerous times to talk to someone. So, on my lunch break, I went to the city, showed them the letter and asked about this tax owed. It was from 2003; I had filed in 2004. So, I don't know if the bankruptcy court should have paid or what. Anyway, no more charges had been added. The city was perfectly fine with me paying my next payday of 17 July 2009, but the lady said I should find out from HSBC what was meant by 30 days - from the date of letter, postmark, or when I got it in the mail.
Well, late afternoon, I finally got through to them and spoke to a human, even though I had left a number for them to call me back. When asked for my loan number, the lady immediately gave me another number to call. When I asked why, no explanation. So, I proceeded with this and finally spoke to another lady. I informed her what the city had told me, and she said she couldn't go by word of mouth - that the city would have to send them something by fax or mail stating they were willing to wait.
I informed the lady that I should be sent another letter since the postmark of the letter didn't come close to when they say it was written, since the number on the letter didn't match the number. She said she discussed it with her supervisor and couldn't mail another correct letter. So, I decided to ask if the enclosed self-addressed envelope had correct address to mail proof of payment of taxes. No, surprise to me, the Pasadena, CA address was incorrect; it should be mailed to an address in Fort Worth, TX.
So, I informed her that I would be taking care of the matter on July 8 by borrowing money from a family member and would not be sending proof of tax payment since HSBC didn't know what the right and left hand were doing. Also, I told her it was because I didn't know where proof of payment was to be mailed to. When I called the number on my monthly statement, I was given a third address, so I told them the same thing and told them their company could find out the best way they could if the taxes were paid.
Three different states have been told to me, and my payment goes to a fourth state each month. None of these people I spoke to stated they didn't know where all this information came from. I said someone should know since they mailed it to me. This is not the first time I have had difficulties with them. I also told them if I could get out from under HSBC and could get refinanced with another bank to take over my loan, I would. I told them if I didn't get this done, it wouldn't be for lack of trying. How do they stay in business?

HSBC is one of two secondary mortgages I have. Early last year, we were falling behind on payments due to having only a single income. I contacted my primary lender (PHH) and the two HELOCs (Ditech and HSBC). Both PHH and Ditech assisted with either a personal loan or remodification by the end of 2008. I have been attempting to get HSBC to modify the loan since July 2008. When I fist talked to them, they said that they were not in the business of selling homes and that they would work with me. By this time, I was about 3-4 months behind. In August, I received a statement with a new loan number, but the account was not made current or modified. I did not pay on this account, for I could not have a loan past due 5 months. What was the point of the new loan if it was not started as current?
By this time, we had started receiving a double income again and could pay a modified loan. I again started to be proactive and finally got someone to speak with me in October where I sent our packet of financial info again. I called multiple times from October through March where I was told that due to the large volume of cases, they would get to my case in a couple of months. Fine. However, since March, I decided not to be proactive and waited for them to contact me once they got to me. This week, HSBC filed for foreclosure here in NY. This without any warning or a response to my multiple packets of info I had sent them. When contacting them, they were not sympathetic. They faxed me the form to fill out again. I have sent the info and documents requested. I will contact them daily until this is resolved. Why should I lose my home due to the fact that they do not have enough staff to handle modifications? Do I have any recourse?

It was suggested to me some time ago that I was a victim of some unethical, if not unlawful, business practice and my inability to analyze my financial situation and act accordingly. I considered filing for bankruptcy but was advised this was not the best thing to do. In addition to other creditors, I am now in debt to Household Finance and the other members of the HSBC Group for $100,473. All this credit was granted based on upgraded appraisals of my house, which probably is not worth anywhere near this amount.
After falling behind on all these loans, I made an attempt to combine them and lower my payments, but I was given different explanations and reasons why it was not possible. When the worldwide economic crisis became known, I was permitted to participate in a temporary program; yet the conditions did little to relieve my situation. I am still unable to get current with my payments. The purpose of the letter is two-fold. Did I create my situation all by myself? Can you direct me to a program that can help me?

Total scam artist. When we went in for a line of credit, we were given paperwork (closing docs). Everything proceeded as we thought well. However, now that we are in hardship mode and were late on a couple of payments, but still making payments for over a year, we now owe more than the original Line of Credit. What a terrible way to do business and to take advantage of people when they are down. I am not sure how this will turn out, but we continue with our hardship and I will make smaller payments to them until we are driven to bankruptcy.

I paid off (so I thought) HFC in 11/2008 - over $10K. In 04/09, I was checking my credit report and noticed that HFC had been reporting me as over 90 days past due balance. They had never called or mailed me statements. I thought they were long closed. The customer service rep (in India, of course) said I still owed $80.09, which I immediately paid by phone and then faxed them, to once and for all, close the account and asked them to please report the account as paid and current on all 3 credit bureaus. In 06/09, my account still showed open and a balance due. I'm not sure what to do, as they are ruining my credit! Thanks in advance for your assistance.

My mom and dad were making their payments. HSBC kept applying fees they wouldn't explain to my dad. He told them he would not pay it but would pay his regular payment. The house was almost foreclosed on because of these fees. My parents had to file bankruptcy to keep their house. After their chapter 13 was discharged in Feb. my dad passed away in March. Now they are saying that there are fees of over $2000.00 that have to be paid. They have started adding more fees even though mom is making the payments and they refuse to explain the fees. She has even sent in written authorization for them to speak with me to see if I could work it out. They refuse to speak with me saying that they never got the authorization and we faxed it to them. At first it was, "Oh, it will take a few days to get entered into the system." Then it was, "It will take at least 7 days to get in the system." Then it was, "Oh well customer service is way behind a lot of authorizations coming in like that so it may take a few weeks." My mom is going to wind up losing the house she has been in for 33 yrs because of this company. If anyone can help, please contact me at **. Thanks.

I received a letter from HSBC Mortgage indicating that I was in default and need to pay $2,913.26 in order to bring my loan current. Since my past due is only $1,200.00, I contacted the 800 number and was told that there is an additional $1,800.00 in (corporate fees). The representative indicated I needed to come current with the past due before the corporate fees could be discussed. I do not see why I would have these fees since I just paid over $8,000.00 to come current on my past due loan. I’m not sure how to proceed?

We currently have two mortgages, one with Countrywide and the second with HSBC mortgage services. Our complaint is with HSBC Mortgage Services. My wife and I used to work for the same company before losing our jobs back in June of 2008. We notified HSBC of going through hardship and we asked for them to work with us finding a program that would help us reduce our mortgage payments. During that time, we used our savings and borrowed money to make our mortgage payments. Ever since we started contacting them to provide info needed for the program, they have not saved our information correctly on their systems. As a result, every time I call, I come to find out they are not gathering our information correctly from us resulting in having to correct them every time I call. Last we heard from them, we were declined on the help and we have a late fee in our mortgage account with them.
Countrywide so far has been way more helpful than HSBC. I am very upset and fed up with the fact that HSBC has been making mistakes left and right. Instead of being helped by them, we get the opposite no help and every time I call is long wait. Is this the right place to submit our complaint or where do I complain? They can't get away with this. I am sure I am not the only one. Our nightmare started before we lost our jobs with the person handling the refinancing of our home. She totally screwed us by us trusting her. I started the whole process back in November of 2007 and we were supposed to close in March of 2008. After May of 2008, it was clear she did us wrong shortly after we lost our jobs and it was even worse.

I have had a mortgage for two years now and my loan amount keeps going up. I was told each year the interest if I was in good standing would go down, but my amount owed keeps rising. I never received an appraisal of my home. They never did one and my home is worth $180,000.0 but they have my mortgage at $270,000. I can't get out. I am stuck. I am trying to sell but I cannot sell it or make the payments. I am not behind on my payments and they take out for my escrow and this last quarter I get a notice from my city that my house is in auction for back taxes. They have not paid my taxes yet they have my money in escrow for it. This is fraud and when I called them on it, they said, "Oh we paid it. Don't know where the money went." So, now what do I do?

We co-signed for brother in law to help him receive financing and they illegally changed it to him being the primary. We have tried to get a payment plan in writing along with a statement saying that they would not file a judgement against our home. We have asked to speak to someone like a supervisor or a director but they say that the customer service rep is in more power than a supervisor or director. This is **. What can we do? These people are not being professional about the matter and are not being reasonable.

My original mrtge. was w/ CHASE - began in MAY '01 at 7.5% fixed rate. About the yr. '03, I refinanced w/ FIDELITY at 5.85% fixed 30yr. They sold the loan to OAK STREET MTGE. and they sold it to HSBC. When HSBC sent me my mo. statement, the monthly pmt. was much higher than what the original pmt. was. I vehemently protested and pd. the lower amt. I had just agreed to at the recent closing. HSBC, after many mos. corrected their error. In 2005, I rec'd. a ck. for @966. Somehow, I only found that ck. in Jan. of this yr. I called HSBC and they researched it & said I'd be getting the new ck. Never rec'd it so called back and again I got the same story.
Each time I called I was put on "hold" for quite a while while they "researched" it. I waited again for at least as long as they told me it would take.They actually said the reason I had not rec'd the ck. was because I had not called to cck. on the status of the ck. The last time I called, a few mos. ago, I was told I would NOT be receiving the ck. at all because they had made a mistake. I believe that they said the amt. of the ck. had to go towards the deficiency of funds in my escrow acct. Last mo., I was notified that due to shortage in escrow, my mo. pmt. would increase by 78.53. NYSTATE has a tax relief program for SRS., called THE STAR PROGRAM. I am in that program so I don't see how my pmts. could be increasing by that much. I just think there might be something "fishy" going on. It seems like they make a lot of errors. I do not trust this bank. When you call customer care, you are calling INDIA. Sometimes, they don't have a clue. It is MOST ANNOYING!!!!
I already am dealing w/ a major disability, multiple sclerosis and so this stress just adds to the situation. sometimes I get too fatigued to carry thru on things. Even now, I type only w/ one hand due to the MS. I am 67 and retired early from teaching (nearly 30 yrs). These increases are not that easy to deal with on my income. Economically, my mortgage amt was originally 140,000. At time of refinancing w/ FIDELITY, the amt. was perhaps @ 137,000 (not exactly sure w/out looking it up). but after refinancing, my new mrtge. was 150,000. They said that was due to closing costs & the fact that I had 1 or 2 mos. "off" before the next pmt. was due. I thought that I'd been "had" but it was too late then. At this time, my principal bal. is 141,546.59, higher than the original mrtge. amt. after 5 or 6 yrs. of paying the new mrtge. off. I feel as tho' I am treading water. I'm not so sure FIDELITY did not engage in some shady wheeling and dealing after hearing all the stuff that's gone on in recent wks. and mos. in the mrtge. industry. I hope you can help.

When I went to HSBC, they had a sign in there store that read, Open a checking account with us and we will take $500.00 off your closing cost! Wow! So I did. On the day of my closing, guess what they offered me? $200.00. So I told them to keep it.
Also, the bank officer never informed me of the village taxes that I would be responsible for. Okay... so maybe by now your saying that was my responisibilty. Ok...So I called HSBC the following seven months to inquire about my village taxes, because I did not want any surprises in 12 months. So every month, I'd call HSBC to ask,guys did you take money out of my account for my villages taxes, because I don't want any surprise later? Yes! Was always there response. On the 12 month, HSBC wrote me a letter stating that my taxes were not taken out of my escrow and now I would have an $218.19 increase in my mortgage. I am soooo fed up with this bank and I am a first time home buyer, and I would not recommend this bank to the devil's niece.
Once again because of HSBC, I have not been able to go on a vaction, because they keep increasing my loan at the time of my vacation period. They have lied to me many times, and my student loans will now have to suffer because I had the increase with HSBC. Please somebody hold them accountable for what they have done.

My husband became disabled, and lost our income. We have since secured disability for him, however the damage is done, and HSBC is bent on taking our home. They will not work with us, even though we are willing and able to pay the mortgage. In addition, after further review, we are clearly victims of TILA, and predatory lending. The discrepencies are astounding. So much fraud within our loan. I brought this to thier attention, and they have no concern
We are going to lose our home. We have so much equity in our home, and HSBC is determined to foreclose.

I borrowed 3500 dollars from them on an unsecured signature loan in 2003. The manager at HFC said that I qualified for the loan but she would not approve the loan unless I got the insurance,the disclaimer read that it was optional. I agreed in order to get the loan. I didn't know at the time but I felt that something wasn't right. I was current paying the loan until I lost my job in 2004.
In 2006 I found out that there had been a hearing and a judgement was placed against me and a lien was placed against my home. I was informed last month that the balance is now over 14,000 and would continue to grow daily until it was large enough to forclose on my home. I tried to settle with them but the settlement amount changes from month to month. In May it was $2375 and in July it was $7500. I just think that HFC wants to take my house and put my family on the street. I'm trying to make ends meet and they're trying destroy them. I really don't know what to do.
It hasn't happened yet but they want to take my house. I still don't understand how a 3500 dollar signature loan turned into a possible forclosure of my families home.

My complaint regarding HSBC Mortgage Services predatory lending practices regarding collections as well as check and balances regarding my account; deceptive mortgage practices, the company failed to post borrowers' mortgage payments on time, when a lender silently accepts payments for several months without notifying the borrower the payments are insufficient then scheme of penalties thereby increasing borrower's indebtedness; HSBC uses dishonest or abusive debt-collection practices, charged unauthorized fees, unwarranted fees.and imposes additional fees on consumers, a process that could result in foreclosures;
I am contemplating filing for Chapter 13 bankruptcy protection, a process designed to help debtors repay what they owe over months or years; HSBC Mortgage Services is untrustworthy. I willing provided several payments during the time I was extremely ill and pulled from my medical payments just to pay them and that was under coercion from their customer service representatives.
It appears that HSBC Mortgage Services is unwilling to work out an amicable repayment solution regarding my mortgage payments referencing the unapplied payment of $1,225.60; I feel at this point in time, I am in need of legal assistance due to HSBC Mortgage Services failure to ensure the accuracy of its claims which encompasses fees charged to borrowers are often poorly identified, making it impossible to verify if such charges are legally permissible or accurate, Are these practices legal under the housing laws and consumer protection laws?
Adverse credit score, affecting my physical and emotional health, incurred financial hardship due to predatory lending instituting excessive fees, account is not correct. This is the worst lender I have every had.

We are a ARM with Citifinicial Mort. Who was willing to refinance at a straight rate. HFC would not subordinate to Citi. However, HFC was more than happy to refinance our Mort. At a higher interest rate. They told us after a year they could lower the interest rate and the payment. I'm not stuck with a 1700.00 Payment on a house that should be about 1200.00. They tell me they can't lower interest or payment because of the economy. We've been borrowing money from other places to keep up on most of our other payments and buy groceries. Of the 1700.00 less than 100.00 is going to interest.
This really don't seem right. They have us so top heavy we can't do anything and are in jepordary of losing cars and making our credit report worse than it was. I'd advise everyone to stay away from HFC! I really feel they have taken advantage of people using the economy as an excuse. They made a promise and now won't stand behind it. This is not a good company they may do things the legal way but they sure don't have any ethics or respect behind their name. they are liars.

These people will not stop calling my home trying to get us to refinance.When i told them i was not interested they started calling asking for my wife. I again told them we were not interested. Obviously they did not care about anything i had to say after that, they were only interested in speaking to my wife. I asked them not to call my home anymore but they continued.
This morning i was awoken again by Shelly who proceeded to argue with me for at least 20 long minutes about how SHE didn't feel they were calling all that much. If it was a door-to-door salesperson that was asked to leave the property but refused..then took it a step further and got into a near yelling match with you about how they don't feel they are coming over too much...I could've called the police and had her arrested, or at least physically removed from my property. The whole thing was just utterly ridiculous. And after all that she still expected us to do business with them!
Loss of sleep. stress for the entire day. I was so upset i started to tremble and shake. And my nose actually started to bleed out of one side. Not sure what was the cause but i'm quite sure the stress and being upset didn't help very much.

They keep telling us they are willing to help but there is no prove of this.They had someone come out & appraise our house for more than we can sell it for. We had a real estate agent work to try to sell it & they had said they would do a short sale on it. When we got an offer they would not agree to it. This was a year or more ago.
We recently sent them about a $1000 as a payment & they ate every bit of it up in interest. They keep adding interest all the time. We are about to the point of losing the house & they could care less. They promised they would send me papers to do a short sale but they never did this. They have recently sent another bill for over $1000. We are getting no where with this loan. I have asked them to lower the amount we owe on this to what it will sell for & lower interest but they have refused. The house will only sale for around $40,000 & we still owe $68,605 on it. There are mobile home dealers in this town that have been sent to prison for doing the same thing they have done. Overpricing on these mobile homes. The FBI should investigate them.
We are under a lot of stress. I am at the age of retirement & have not been able to. I will probably never live to see it paid for. The balance never goes down. They told us if we paid every 2 weeks on this it would help us to getit paid off earlier. They kept adding interest all along. We still have not gotten a straight answer from them as to why interest keeps adding up. Surely we can't be the only people they are doing this to.

I had a previous equity loan with HFC and made my payments on time and was asked if I wanted to refinance that loan and my present loan into one loan with a lower rate and if I paid on time I would get a lower rate each year. Well, this was a loan, but not the typical loan that my husband and I thought. It was an all equity loan with a lower interest rate, but the patment was due on the 1st even though I requested the payment date to be on the 3rd when I get paid. I am disabled and my husband is retired and we adopted our 5 grandchildren. A lower interest rate sounded good and I even asked after seeing something that I thought this was not a typical loan and I was told it was. I even asked about late payment in case I had to pay late for some reason and this is when they called the manager in and he assured me they had no late payment and this was a typical home loan.
We signed and then due to health we were forced to file Bankruptcy. When the paperwork came in the attorney said I had an all equity loan and the laon amount was higher than I took out. After the Bankruptcy in August 2006 I was never sent a bill since then and just this year got a interest paid paper from the company and I paid all interest and when I asked for pay off info I was told I owed deferred interest that had to be paid at the end of the loan. In addition to this rip-off, I was told that I had to carry insurance covering the whole amount of the loan even though the property was not worth what the loan was taken out for. I never saw an appraiser and they said they didn't need to see the inside and when I requested the apprasial, I was ignored. I was stuck with this loan, my insurance went sky high because it is a manufactured home with a high loan on it, and I am unable to get anyone in this day and times of recession to even give me a decent loan. This loan will never be paid off. Not unless I can send the full$692 in monthly on the 1st and then send a seperate check for about $700 towards the principle every month. I can't do that for one month.
I was sure lied to, but how can you even begin to prove that you questioned this loan and was told it was just your typical loan with a lower interest rate. With the Bankruptcy on top of it, another company will not touch me and the home value has plummetted greatly. I don't see how these people sleep at night. My insurance company said that if I do not keep the insurance on it, they can put there own insurance on it. I paid $692 faithfully every month, but on the 3rd as I told them and they have still refused to sent one bill since the bankruptcy, but the end of year interest paper stated I paid the total amount to interest. Will, I ever pay this off? No, it will continue on and on and as long as values of homes go down I am in a hopeless situation and trying to take care of grandchildren with bad health.
My health has continued to fail since this loan and I see no end in site. Why do I have to carry the full amount of the loan in home insurance which makes it worse? My credit shows that I am paying no mortgage since they do not report or send a bill. I hope someone has the money to take a class action suti against them for the loan practices they use.

I called to refinance my loan to a lower interest rate. He sent me phony loan document and told me not to worry about them; he was doing this to get the loan through. I specifically asked him if he had any intention of selling my loan to another company, and he said definitely not. He told me that I was an excellent customer, and their was no reason to sell the loan to another company. I told him that I wanted to stay with HFC and not go with any other company. He said not to worry, I would still be with HFC.
Well, the liar sold my loan to Countrywide Bank, and this is fraud on his part. I have heard nothing but bad reports on Countrywide and am not happy with this. He has lied to me from the start, and I trusted him. I hope there is something you can do to him for this betrayal.

I felt as if I was a target of HSBC, so I must say I feel a little better knowing their incompetence is not just directed to my loan. Our loan was purchased at the beginning of 2007, after a long and difficult period with another bank. I am very careful to pay this loan on the due date and over the phone as this loan was in foreclosure and we had worked very hard with the other bank to bring it back current.
Beginning in September, and with their automated system, the incorrect amount was pulled from my checking account leaving the payment in limbo, not being posted anywhere and causing me to be behind one payment on the next statement. After several attempts to find out what happened, we corrected the payment and the late fee was made. I made another payment over the phone with a person and because I used a different checking account, and the person didn't change the routing number, the payment was returned account not found, and so began three months of mess with me finally writing a letter to make someone understand.
I thought this was corrected when I received a letter of apology in January, but now, after receiving 3 statements asking for just one payment, I received a phone call from their out-of-country collection service telling me I am a month behind due to a missed payment in October! I tried to fix it with one phone call. They sent me a letter telling me they set me up with a hardship payment plan and skipped two months worth of payments. Can you just believe that! I wasn't a month behind, I just wanted to pay February! I again wrote a letter! I'll let you know how it goes!
Words can not describe the frustration. This company causes me to lay awake at night! I do not have this with my first mortgage, Wells Fargo!

I have made my monthly payments starting in March of 2006 each and every month. HSBC is now stating I am two months behind. I have sent them all the proper paperwork from my bank supporting these facts, have made over 50 phone calls and HSBC will not remedy the problem that is now affecting our credit to where we are unable to re-finance our loan and also have over $1000.00 in late fees that HSBC states we owe. We are at our wits end we don't know what else to do.
Our credit has been damaged, fees incurred time and energy put into trying to fix this problem that is not of our making.

I inadverdantly wrote a check for thirty dollars less than the correct amount for my mortgage, $960ish as opposed to $990ish, and hsbc parked the money in an unapplied funds account and sent me notice that payment was short and that I must pay immediately, or a mark would appear on my credit. Well, it did. I received word that negative information was reported, and my credit was being curtailed. I appealed to hsbc, but was denied. A second appeal yielded better results, a reversal or removal of the mark. Coincidentally, I was perusing the mortgage document the other day,and on page four of the hsbc mortgage, there is a section called application of payments or proceeds, which clearly states the application of funds received. It would appear that hsbc violated the terms of the contract when they put the money in an unapplied funds account, instead of interest, then principal, then other obligations.
So far, in it's infancy, t has caused me to pay higher interest rates, and a minor reduction in available credit.

In an attempt to bring my mortgage payments current, after an increase in December, 2006 (ARMS Loan), I sent two payments for $766.33 on 02/23/07 & 03/02/07. However, the total amount of $1,532.66 was placed in an Unapplied Funds account, and my mortgage account was allowed to accrue 'Unpaid Late Charges/Other Fees' due to this 'clerical' error which exists, to date.
I am in a financial dilemma due to the fact that I am faced with another mortgage increase in December, 2007! My credit ratings have been adversely affected, and remains a hindrance to my acquisition of a fixed rate loan.

I had a $5000 line of credit with HFC since 2005. In 2006 a paid the balance in full but left the account open for future use. I never received statements on a regular basis. The last statement I received was dated August 13, 2007. The statement stated that I had a $0 balance and the credit available was $5000. On September 26 or 27 I drew a check totaling $2500 from this HFC credit line and deposited into my checking account. By September 28 my bank had applied the $2500 to my account. On October 3, my bank had put a hold on the $2500 because HFC said the account was closed. On October 4 my bank confirmed that HFC was not going to honor the check.
I contacted HFC on the 4th of October. I called several times and left messages but no one got back to me. I called back at around 10:30 and I was connected to Mike, the manager. He said it was HFCs policy to close accounts that have not been used in a year. My argument was that the last correspondence I received from HFC was the statement dated August 13, 2007. No where on the statement did it state that my account was in danger of being closed. Also, if this is indeed the case and accounts are closed for inactivity in a year, why was my account still active in August 2007 when I paid off the account in June 2006?
Mike, the manager, ask for my September statement. I told him I never received one he said I must have, along with a notice informing me that my account was closed. He also said it is common practice to close accounts with no activity within a year. I told Mike that it might be common knowledge for someone in his business but for someone who knows nothing about the banking industry how could I have known! During our conversation, Mike made several attempts to try to convenience me to apply for another account over the phone.
In the meantime I have accumulated over $250 in bank charges for bounced checks, missed day of work trying to resolve this situation and experienced extreme embarrassment because of the bounced checks!
Today, October 5, 2007, I was curious to see the status of this account online. I had never activated access to my account until today. I was able to activate and access the account. No where on any of the web pages did it state that my account was closed, the only statement posted was August 2007. One of the pages also stated a current amount due of $129! I paid this account in full over a year ago. I have made copies of all the web pages.

HFC sent a check that stated THIS IS A REAL CHECK FOR $5000 It's valid until May 16,2007. Date on check was May 16, 2007. I deposited on May 16,2007 at Wacovia Bank drive thur before 2:00pm it was credit to my account, then June 20th I show a -3882.96, I called Wacovia to find out why it was neg they told me that the $5000 check was returned but would not know the reason until June 21st. I immediately called HFC surely they would know, they knew nothing.
Armando said he would investigate and call me back in a couple of hours which he did not. I called after approx 5 hours and he said he had turned it over to his Manager and for me to hold while he checked, he came back to the phone and said I needed to find out from my bank why it was returned, which I did the next day.
I called Thursday June 21st and spoke with Armando and told him the bank told me the check was returned because of a stale date, which meant May 16th was too late to deposit, and I told him I was getting bank fees for this check and bills that was set to go was going and again I am getting fees for the bank paying them and my account in the negative. ... I never spoke again with Armando. I tried going online to find an e-mail address that I could e-mail the CEO, Customer Service or someone about this, there is no contact other than a 1-800 number which they cannot do anything I was advised by customer service to call the local office. What a scam.
At this point I owe over $100 in bank fees I do have the negative bal down to $1800 my using my own money to put in the business account, now I have to come up with that.

Seth Lotes was harrassing me to get a loan with HFC. Constantly calling me even when I continuously told him I didn't want to business with him and to stop calling me. He sent me letters thanking me for choosing HFC when I hadn't committed to anything. I tried calling his manager (Mr. Del Franco) who was too busy at the moment but I left my name & # with him. He never returned my call. I wrote a letter to Mr. Del Franco to explain the situation and also to tell him to intervene to stop Mr. Lotes' harrassment.

I requested two months of payments to be processed. Both request were ordered on the same day but to be processed on different days. They accepted one and rejected the other saying that the account was closed (even though both drafts were from the same account) After speaking with them for 4 hours and 9 employees later, they realized there was a glitch in there computer and because I was requesting two payments, it (the computer) could only recognize one and therefore rejected the other. Sounds like @#%! to me but heres the problem. They were ready to charge me late fees and processing fees that occured because of a problem they created. I told them no way. They said okay they would reverse the fees and make it look as though I was not late. My bank agreed to verify account balance and activity with them but they chose not to. I had to ask them for a letter of apology and the response from the manager was sure in a very, very, sarcastic tone of voice.

hfc has ruined our lives, a lender from that office explained to my wife and i how this is the best thing for us and that he was a finacial planner we believed him the more you take the better rate you'll get not realizing but hfc did this to us more than once i guess you call it flipping loans over and over again. We began running short and couldn't pay they also took unsecured debt and turned into secure debt now it is a second mortgage now we are losing our home from both new century and hfc, we are there 20 yrs with 2 kids.

Two hours from now I will be paying off an eight thousand dollar debt to HFC. I am only able to do so by transferring the debt to a reputable bank and paying them a resonable interest rate. I would truly rather owe a loan shark or bookie than HFC.
This began when a live check arrived in the mail. It was a real check and at that moment in time we were in need of money. We read every word of the paperwork and did not see the interest rate posted...only the monthly payment which was well within out ability to pay.
The check was deposited and we soon found ourselves paying 28% interest. Every month we paid over two hundred dollars and the total actually went UP.
After a year of paying and seeing NO PROGRESS I asked them to lower the interest rate. Rather than do that they tried to pressure us into a second mortgage to pay off the other debt. They offered a HUGE interest rate for a second mortgage (ten points over what we were paying).
Thank goodness we did not bite.

I took out a 2nd mortgage in 2000. At the time the loan officer insisted that I did not need an appraisal, that I need only estimate the current value of our house and land. When I said I had no idea of the value, she said that property values in our neighborhood had gone up 15%. Not knowing any better, I said, OK.
In 2006, after a number of previous attempts to refinance, HFC had an appraisal done. The estimated value was less than the sum of our 1st and 2nd mortgage loan balances. When I questioned the appraisal, I was told that manufactured houses do not appraise as high as site-built houses. That was the first I'd ever heard of this difference in appraisals. Had I known this in 1999, and had HFC done an appraisal, I would not have obligated myself for more debt than the value of the collateral. And I'm sure HFC would not have extended the credit. I have been trying off and on for months to obtain an address at HFC to which I can send a letter of complaint and request an adjustment in the loan (lower interest rate, reduction in loan balance - something!) but have not located one.

The company gave me a personal loan which I later converted to a Home equity loan. Everything was very well disclosed and made known. I don't know how any of the other companies could possibly happen. Also the insurance is not paid out of pocket. It is a fixed monthly premium or rolled into the unsecured note (with option to cancel).

My husband and I refinanced our second mortgage to access some equity and HSBC bought the contract back in October of 2005. This company has been a complete nightmare they resort to bullying children by telling them if their parents don't pay their mortgage that day they will be on the street. Mind you the payment was not late but maybe 2 days into the grace period.
They have posted all of our payments when they felt like it rather than when they were actually made. A false late payment of over 30 days past due was put on our credit and there is nothing we can do. Today Jan. 27th, 2007 11:00 AM I made my house payment three days before it could actually become late and their website would not allow me to post it before the 30th but it still would not be late so I went ahead and made it.
A phone call was made to my house and my husband answered and the person on the phone proceeded to harass my husband asking for personal information and then told him that he needed to change the payment to today or his account would be in collections. My husband was confused since we are not a month behind. He told him we are not late they answered you change your payment to today and everything will be ok my husband responded no it has already been done on line and we don't want to be charged twice . He handed me the phone I told the man on the phone that we had a grace period and it was our right to use it and that their website would not allow me to post it before Monday.
I know he said but you must change the date with me on the phone to today or it will go into collections. At this point I became very angry and told him not to call my house again to threaten me that he had no right. A supervisor I believe called the house immediately after and threatened me with recalling my mortgage because of my attitude. I am fed up with this company -- from the beginning of our loan our statements have shown as if we are always a month late which has never been true.

They are not applying our payments correctly. They are stating we are past due, but this is because they are applying one of the payments to principal. We are not doing this, nor have we indicated in our correspondence that the payment should be towards principal. I have my payments coming from 2 different checking accounts and we are dividing the amounts equally.
They are getting 2 checks for each account. One check under the name of Mark F. W and the other check under the name of Maria A. I asked them to please remove any late charges and correct your internal error. I am certain they must get payments from 2 different accounts applied to 1 mortgage payment frequently, and this has never been a problem until recently. So, then they send us a letter on 11/27/06 saying it has been fixed and then we get another letter saying they are investigating it!?! Now we are back to square 1. They are saying we owe about $2000.00 and we don't! They just don't know how to apply the payments and have untrained people handling their money.
It's putting incredible stress on us. We don't owe this money to them. They need to hire people that can add, subtract, and divide. We have never had a problem like this with our previous mortgage company and we don't want it to affect our credit because of THEIR error. I am in the mortgage industry and know how the system works. Their customer service personnel won't let me talk to a supervisor so I have sent them 2 letters now. It's frustrating that these people deal with millions of dollars and can't figure out how to apply payments. I'm tired of contacting them every month.

I got my first mortgage with a small company who immediately sold it to Household. Over the past four years, I have realized that signing anything with these people was the biggest mistake of my life. When I got behind by two payments and tried to reason with them and even sent them one payment, they returned it. I was forced into foreclosure, so I filed for Chapter 13 to save my house. Even though the late payments and all of their outrageous legal fees were covered in the bankruptcy payment plan, and I continue to make my regular payments directly to HSBC my balance is even higher than the original mortgage that I took out four years ago. Also, with the adjustable rate, the payments keep going higher and higher. I never get a statement, just a notice that the payment has gone up or is going up.
I don't know where to turn. I can barely make the payments. My bankruptcy payments are taken right out of my paycheck. Every day, I worry that I will lose my home and I can't sleep at night. I thought that filing bankruptcy would help me to keep my home, but HSBC seems determined to take it away from me, no matter how hard I try to meet their demands. I work full-time and take care of my disabled daughter and disabled mother. HSBC is starting to take a toll on my health as well as I suffer from anxiety attacks now.

I was recently told by my HFC rep. that they wanted to refinance my loans into on loan to give me a better rate - since I have been paying my loan on time for the last 12 months. (I had been taken financially & emotionally by a scam artist in 2002, which left me financially devastated-which caused me to be behind in my mortgage payments.) HFC rep recommended that I refinance my auto loan as well & buy the REQUIRED life insurance through them. I refused the loan within the allowed timeframe.
I was able to refinance through a different company and even though my existing loan is $98,000. HFC states that my payoff is $107,000. They tell me that since I was late in the past, that I have Deferred Interest due of $9,000. I can not get anyone in HFC customer service or the branch office to tell me where this information is listed in my loan. The new mortgage company, the escrow service & my banker tells me that I am being ripped off.
Having to pay $9000.00 in deferred interest that I was unaware of has caused me economic hardship + knowing that they have scammed me has caused me physical and emotional pain.

In April of this year, I received a late notice from HSBC for a mortgage payment which I had paid. I called HSBC and learned that they had received the check but for some reason had posted the receipt to my escrow account instead of to my mortgage payment. They assured me the problem would be taken care of, so I paid no further attention to the matter until recently when I learned that they had reported my payment as late to the credit bureaus. I called them today and they are unwilling to correct their error because they now say they have no knowledge of the payment in question being posted to my escrow account.
The negative impact on my credit report will affect my abilifty to obtain competetive loan rates in the future.

Hsbc continues to practice what I deem as unethical. I made a payment on Friday Oct 6th 2006 at 6:50 am. I clicked on the date of payment to be 6 oct. When I clicked submit, they changed the payment date to the 9th of Oct.This caused my payment to post as late. This is not the first time I think they have done this. But as some of their practices do not seem ethical, I am starting to watch them. But once you click submit, you can not change anything, other than submit another payment.
They continue to raise my interest and charge outragous penalties.

I was billed for insurance when I already had it on the property. I sent the information to them on more than one occasion. My husband talked to them about six months ago and they said they had the proof and they would fix it. They continued to still bill me for the insurance. I called in January again and they said that I have to wait until the company refunds their insurance acct and then they will stop billing me. Just Monday, March 13, this had not been even started. So, I am forced to pay the extra insurance and if I don't they report me to the credit bureau.
Also, with this loan, there is a rollback feature, meaning that if you make your payments on time for 3 years, your interest rate drops in the 3rd, 4th, and 5th years. I called in 2004 to have this done and it has not been taken care of. When I called this week they said it had to go to their research department. I feel really in a lose lose situation with this company because I am being overcharged now, not only for insurance, but for my interest rate. Which to me means that my interest paid that I report on my taxes is or should be wrong, because I am being charge the wrong interest rate. I think they should have to compensate me for as much of money they are holding and charging me wrong.

i have a mortgage that was purchased by HSBC from the company that originally sold me the mortgage. The terms and condition of the loan clearly states that the amount of monthly mortgage paymeny, also vlearly stated on all documents, include all taxes and insurance. This is the reason I decided to do business with the company after shopping around for an arrangement that would fit my budget.
But HSBC now decided even without consulting me increased my monthly mortgage payment from 1373 to over 1600 dollars. They obviously did not want to honor the existing terms and conditions in the note they purchased. They have in effect create new terms and conditions to which I am not a party. I have written them that I am ready to go tocourt on this matter. I will continue to make payments in accordance with what is contained in my mortgage note. I believe what HSBC has done is illegal

I refinanced in January, 2005 - I requested that my payment date be on the 1st because I am retired. I get several phone calls on the 1st of every month requesting I make a payment. I am not considered late until the 15th of the month. It is very upsetting to me when I know my mortgage is my first priority and I have said this serveral times. I spoke to a floor manager by the name of Ms. Kanthi K on 2/1/06 around 4:30 pm. I explained the problem to her and since then I got 4 more calls. I think I made some one very angry and they decided to get back at me and put my number in the system.
At this point I am taking this very seriously. In no way have I played games with this company. I am a retiree and I make it clear to all of my creditors that all of my payments are made on the 1st. What am I doing wrong? I started receiving calls today 2/1/06 at 12:10 pm. Since that time I have gotten calls at 12:38, 12:49, 1:48, 2:44, 3:59, 4:48, 5:11, 5:44 pm. It is now 6:45 pm - last month the last call came in around 8 pm.

My mortgage payment was $1,987.32, they increased it to $2,379.32. The amount increased was $392. This action was taken with out my concent,and out of contract. I signed a two year fixed rate, no matter if it was sold on the secondary market payment should not be affected. They call me and harrased me regarding my monthly payment, which I refuse to pay. Unfortunately I can only retrieve their P.O. Box address I hope that it will be of any help.
The damage is an extra $392 a month will total to an extra $4,704 a year. I do have a family, I provide for.

I have made the following payments on my second mortgage: September 8,2005 $583.12 Cleared Bank September 8,2005 $67.00 Online payment due to company spokesman stating that i owed more money. Paid and amount not credited. September 13,2005 paid $58.00 through there online service. Again payment not credited. Now I have overpaid them for my August payment and have received several calls per day from them trying to collect my payment which I have already made.
Once they look at my file they say.....OH your payments are in the research department and we do not now why the payment has not been credited but promise to not call anymore. Then the next day I get bombarded with phone calls from this company starting this all over again. I am not behind on my payments but am concerned about making this months payment. Also when visiting their website the balance as well as the payment amount due etc never match my monthly bill.
