Nissan recalls nearly 308,000 vehicles with airbag issue

Nissan North America is recalling about 307,962 model year 2001-2011 Nissan and Infiniti vehicles.

The recall includes:

  • Model year 2001-2003 Maximas,
  • Model year 2002-2006 Sentras,
  • Model year 2002-2004 Pathfinders,
  • Model year 2007-2011 Versa Sedans & Versa Hatchbacks,
  • Model year 2001-2004 Infiniti I30s& I35s,
  • Model year 2002-2003 Inifiniti QX4s,
  • Model year 2003-2008 Infiniti FX35s & FX45s, and
  • Model year 2006-2010 M35s & M45s.

The recalled vehicles are equipped with non-desiccated, front passenger airbag inflators containing phase stabilized ammonium nitrate (PSAN) propellant that were used as interim remedy parts for previous Takata recalls.

These inflators may explode due to propellant degradation occurring after long-term exposure to high absolute humidity, high temperatures, and high temperature cycling.

An inflator explosion may result in sharp metal fragments striking the driver or other occupants resulting in serious injury or death.

What to do

Nissan will notify owners, and dealers will replace the front passenger air bag inflators with alternate desiccated inflators free of charge.

Nissan recalls Nissan Muranos, Maximas, Pathfinders and Infiniti QX60s

Nissan North America is recalling 394,025 model year 2015-2018 Nissan Muranos, model year 2016-2018 Nissan Maximas, and model year 2017-2019 Nissan Pathfinders & Infiniti QX60s.

These vehicles were previously recalled and unrepaired, or inspected and determined to not need a repair, under an earlier recall.

In addition, this recall expands the previous population. The Anti-lock Brake System (ABS) actuator pumps may allow brake fluid to leak onto an internal circuit board.

A brake fluid leak on the circuit board may result in an electrical short, increasing the risk of a fire.

What to do

If the ABS warning light remains illuminated for more than ten seconds after engine start up, owners should park the vehicle outdoors away from other vehicles or structures and not drive it.

Nissan will notify owners, and dealers will replace the ABS actuator free of charge.

Interim notices informing owners of the safety risk are expected to be mailed beginning December 2, 2019. Owners will receive a second notice when remedy parts become available, currently expected to be during summer 2020.

Nissan recalls 1.2 million model year 2018-2019 vehicles

Nissan North America is recalling 1,228,830 model year 2018-2019 Nissan Altimas, Frontiers, Kicks, Leafs, Maximas, Muranos, NVs, NV200s, Pathfinders, Rogues, Rogue Sports, Sentras, Titans, Versa Notes, Versa Sedans, Infiniti Q50s, Q60s, QX30s and QX80s.

The back-up camera and display settings can be adjusted such that the rear view image is no longer visible and the system will retain that setting the next time the vehicle is placed in reverse.

The valves within the ABS Hydraulic Control Units (HCU) may react with brake fluids containing specific corrosion preventative additives. This reaction may cause the valves to not close properly.

Nissan making automatic emergency braking standard

Car commercials often show advanced safety features without pointing out that they are only available on top-of-the-line trim levels, at added cost. Buy a base model and you don't get it.

But now Nissan has announced it will make automatic emergency braking (AEB) standard on a projected one million vehicles sold in the United States for model year 2018. AEB uses radar to hit the brakes when it senses an obstruction that could cause a collision. It's an accident avoidance system that likely has saved a number of distracted drivers from an accident.

Starting with 2018 models, the system will be standard on Rogue/Rogue Sport, Altima, Murano, LEAF, Pathfinder, Maxima and Sentra, except those with manual transmission, and all NISMO versions.

'Big step forward'

“Making auto braking standard is a big step forward in safety,” Kelley Blue Book analyst Jack Nerad said in an email to ConsumerAffairs. “Officials from the National Highway Traffic Safety Administration have grown increasingly dismayed at the lack of consumer interest in purchasing optional safety equipment, despite its proven ability to save lives. By making this system standard on so many vehicles, Nissan is providing added safety across a broad swath of its product line.”

Nissan is making the feature standard four years before federal regulations go into effect, requiring it on all new vehicles.

Honda, meanwhile, is accelerating plans to put self-driving cars on the street, that will automatically brake, but also obviously do lot more. Automotive News reports the carmaker has outlined its plans to develop autonomous cars with level 4 capability that can drive on city streets by 2025. Left unsaid, of course, is that these vehicles will be very expensive and the self-driving technology will not be included on base models.

Still, technology is slowly making its way into the least expensive vehicles, making them safer.

In a 2013 study, the National Highway Traffic Safety Administration (NHTSA) found that one-third of all police-reported crashes involve a rear-end collision. Nissan contends the NHTSA data show that systems such as AEB can help reduce injury insurance claims by as much as 35%.

British woman who reported sudden acceleration in her Nissan is cleared of killing pedestrian

A woman in the United Kingdom who testified that her Nissan suddenly accelerated on its own was recently cleared of killing a pedestrian.

Ann Diggles, an 82-year-old retired nurse, was parking her Nissan Qashqai in the town of Leyland in 2014 when, she said, her car suddenly shot forward. The vehicle plowed into a curb, hitting and killing 53-year-old Julie Dean. The case received significant attention in the British press, as the Qashqai is Britain’s fifth best-selling car, according to the Daily Mail. 

That specific Nissan model is not sold in the United States. However, Nissan is one of many car makers whose United States drivers also gripe of sudden unintended acceleration (SUA), or the phenomenon in which a driver says their car took off on its own as the brakes failed.

Other Nissan models target of SUA reports

A search of “Nissan” and “unintended acceleration” in the United States Highway Traffic Safety Administration’s voluntary database turns up 23 reports. The most recent report, from January 31, describes an accident in which a 1993 Nissan Altima suddenly accelerated as the driver was going into reverse. “THE CONTACT SUFFERED FROM HEAD, ARM, SHOULDER, AND LEG INJURIES,” the report says.

In 2015 Nissan agreed to recall 298,747 of its Versa and Versa Note models over sudden acceleration concerns. The NHTSA had begun a probe into the cars’ engineering and sudden acceleration a year earlier. Rather than blame the sudden acceleration on a mechanical or software issue, however, Nissan linked the problem to drivers’ shoes.

“Nissan says the right edge of the driver’s shoe may catch the edge of the center console lower trim panel,” causing the accelerator to become depressed, according to a report from the Detroit News.

Computer issue vs. driver error

Like Diggles, owners of Hyundai vehicles and a Tesla have also publicly claimed that their vehicles suddenly accelerated while they were parking.

"If you're turning into a parking space, you have a lot of stress on the front drive system,” Samuel Seco, an electrical engineer who has studied sudden acceleration in cars for over 20 years and provides expert testimony in civil and criminal cases involving the issue, told ConsumerAffairs. “Since everything is based on running through the computer, including sensors on your drive systems, any one of those could carry onto the system, carry on to the on-board computer and attack it."

But the automotive industry, along with the National Highway Traffic Safety Administration,  have maintained  that sudden unintended acceleration is caused by driver error, not the computerization of vehicles. Preston Crown Court attorneys prosecuting the Diggles case, working with experts from Nissan, told jurors that there were no problems with Diggles’ car. Nissan’s Deputy General Manager Takuma Nakamura even flew in from Japan to testify for the Crown Court prosecutors and vouch for the safety of Diggles’ vehicle.  

Attorneys for Diggles said that a malfunction in the car’s electronic throttle, in which a computer controls the throttle opening settings, had caused the “uncommanded acceleration” in her car. Nakamura claimed in his testimony that the car’s computer has a “self-diagnostic feature” which would allow the car to record any such malfunctions.

Other Nissan owners come forward

Two other Nissan owners contacted Diggles’ attorneys after reading about her case in the news. On short notice, they agreed to testify about their own experiences with sudden acceleration at her criminal trial.

On February 7, shortly after jurors cleared Diggles of killing Julie Dean, the trial judge reportedly said that the two witnesses “are to be commended for the efforts that they individually took to contact the defense and come to court at very short notice.”

Model year 2016 Titan Diesel XDs recalled

Nissan North America is recalling 12,112 model year 2016 Titan Diesel XDs manufactured August 7, 2015, to September 1, 2016.

The vehicles may not have had the temporary fuel tank breather tube cap removed during the vehicle's assembly and the fuel tank breather tube may not have been connected to the bed rail. As a result, the fuel tank may not have the proper ventilation, possibly causing the fuel gauge and the distance to empty meter to both display inaccurately.

If the fuel gauge reads incorrectly, the vehicle can run out of fuel without the driver being aware, increasing the risk of a crash.

Nissan recalls model year 2013-2014 Pathfinders

Nissan North America is recalling 79,853 model year 2013-2014 Pathfinders manufactured June 20, 2012, to June. 13, 2013.

The brake light switch may have been installed incorrectly causing the relay to remain in the "ON" position and the brake lights to remain illuminated even when the brakes are not applied. Additionally, the brake light switch may interfere with the brake-shift interlock, allowing the driver to exit the vehicle without the transmission in the "PARK" position.

If the brake lights remain illuminated, other drivers may fail to stop when the vehicle actually brakes, increasing the risk of a crash. If the driver exits the vehicle without the transmission in the "PARK" position, the vehicle may roll away, increasing the risk of injury.

What to do

Nissan will notify owners, and dealers will inspect the brake light switch and, as necessary, replace the relay, free of charge. The recall is expected to begin on July 25, 2016.

Nissan North America is recalling 18 model year 2015-2016 GT-Rs manufactured February 24, 2014, to June 16, 2015 to be sold in Puerto Rico.

The recalled vehicles have a Certification Label that is missing the Gross Vehicle Weight Rating (GVWR) and Gross Axle Weight Rating (GAWR) information. As such, these vehicles fail to comply with the requirements of 49 CFR Part 567, "Certification."

Due to the label missing the GVWR/GAWR information, the operator may overload the vehicle, increasing the risk of a crash.

Nissan recalls vehicles with OCS issue

Nissan North America is recalling 919 model year 2013-2015 Altima and Pathfinder vehicles, 2013-2014 Nissan Sentra vehicles, 2013 Infiniti JX35 vehicles, 2014-2015 Infiniti QX60 vehicles and 2014 Infiniti QX60 Hybrid vehicles.

The recalled vehicles received an incorrect occupant classification system (OCS) control unit during a repair. The units may incorrectly classify the front passenger seat as empty, when it is occupied by an adult.

If the OCS does not detect an adult occupant in the passenger seat, the passenger air bag would be deactivated. Failure of the passenger airbag to deploy during a crash (where deployment is warranted) could increase the risk of injury to the passenger.

Nissan will notify owners, and dealers will update the OCS software, free of charge. The recall is expected to begin in November 2015.

The vehicles may have been built with driver or front passenger seat belt assemblies that may not latch properly or may not unlatch when the release button is pressed. A seat belt that does not latch properly would not restrain a user, increasing the risk of injury in the event of a crash. Nissan North America is recalling 9,614 model year 2015 Muranos manufactured December 4, 2014, to March 17, 2015.

These vehicles are equipped with Anti-Lock Braking System (ABS) actuators which may have contamination in the solenoid valves, potentially affecting the valves' ability to completely close and allow a build up of hydraulic brake pressure, or fully open and allow the hydraulic brake pressure to completely drop.

Under some driving conditions, when the ABS is activated, the malfunctioning ABS actuator could cause a loss of vehicle stability, increasing the risk of a crash.

Nissan North America is recalling 16,973 model year 2008 Infiniti EX35 vehicles equipped with the power tilt/telescope option included in the premium package, manufactured June 29, 2007, to April 25, 2008; 2009 Infiniti FX35 and FX45 vehicles manufactured October 31, 2007, to April 16, 2008; and 2009 Nissan GT-R vehicles manufactured March 14, 2007, to April 25, 2008.

The steering column outer tube may not be round, resulting in extra stress being applied to the upper steering bearing. This stress may cause the bearing retainer to fracture, creating extra play in the steering wheel or a possible loss of steering. Extra play in the steering wheel or a loss of steering may increase the risk of a crash.

Nissan will notify owners, and dealers will replace the steering shaft on the Infiniti EX35, FX35, and FX45 vehicles, and will replace the steering column assembly on the Nissan GT-R vehicles, free of charge. The manufacturer has not yet provided a notification schedule.

Nissan recalls various vehicles with fuel pressure sensor issue

Nissan North America is recalling 133,592 model year 2012-2014 Nissan Juke, 2012-2013 Infiniti M56, QX56, and 2014-2015 Infiniti Q70, and QX80 vehicles.

Nissan recalls various Infiniti hybrids with throttle issue

Nissan North America is recalling 6,562 model year 2013-2014 Infiniti M35 hybrids manufactured April 7, 2012, to September 9, 2013; 2014 Infiniti Q50 hybrids manufactured December 10, 2012, to July 15, 2014; and 2014-2015 Infiniti Q70 hybrids manufactured April 9, 2010, to May 7, 2014.

Due to a software error, the signal could be lost from one of the two throttle position sensors (TPS), sending the engine control module (ECM) into a fail-safe mode, partially closing the throttle chamber.

Nissan North America has issued a pair of recalls for Infiniti hybrids with transmission and electric motor problems.

The first involves 817 model year 2014 Infiniti Q50 hybrids manufactured October 16, 2013, to January 27, 2014, and Infiniti Q70 hybrids manufactured November 7, 2013, to December 10, 2013, that may have been assembled with transmissions whose housings were damaged during their manufacturing.

The damaged housings could crack and fracture, creating road debris and disabling the vehicle, increasing the risk of a crash.

Nissan will notify owners, and dealers will inspect the transmission assembly and replace it if cracks are found, free of charge. The recall is expected to begin in mid-November 2014.

Nissan recalls Infinitis with air bag issues

Nissan North America is recalling 1,848 model year 2013 Infiniti QX56 vehicles manufactured September 1, 2012, to April 26, 2013, and 2014 Infiniti QX80 vehicles manufactured June 18, 2013, to February 11, 2014.

The driver's frontal air bag inflator in the affected vehicles may have been manufactured with an incorrect part. In the event of a crash necessitating deployment of the driver's air bag, the incorrect part may block the flow of propellant to the air bag and the air bag's inflator may rupture. The rupture could cause metal fragments to strike and potentially seriously injure the vehicle occupants.

Nissan Altimas recalled

Nissan North America is recalling 220,423 model year 2013 Nissan Altima vehicles manufactured March 6, 2012, to February 28, 2013.

Interference between the hood inner panel and the secondary latch lever, in combination with debris and corrosion, may cause the secondary hood latch to bind and remain in the unlatched position when the hood is closed.

If the primary latch is inadvertently released and the secondary latch is not engaged, the hood could unexpectedly open while driving, increasing the risk of a vehicle crash.

Nissan will notify owners, and dealers will be instructed to modify the bend angle of the hood actuation lever to eliminate potential interference with the hood inner panel. In addition, dealers will clean and lubricate the latch joint as needed. If significant corrosion is observed, the latch assembly will be replaced. This repairs will be performed free of charge. Nissan recalls Frontier Crew Cab vehicles

Nissan North America is recalling 1,319 model year 2014 Frontier Crew Cab vehicles manufactured June 11, 2014 to June 26, 2014.

The affected vehicles were manufactured with an out-of-specification anchor nut installed on the weld nut plate where the rear seat belt anchor is attached. The seat belt anchor bolt may not be attached as designed.

Nissan recalls vehicles with air bag defect

Nissan North America is recalling 226,326 model year 2002-2003 Nissan Maxima, Pathfinder and Infiniti I35 and QX4; 2002-2004 Nissan Sentra and 2003 Infiniti FX vehicles.

A safety defect in the passenger side frontal air bag may produce excessive internal pressure causing the inflator to rupture upon deployment of the air bag. This recall addresses both the passenger side frontal air bags that were originally installed in the vehicles, as well as replacement air bags that may have been installed as replacement service parts.

A replacement air bag may have been installed, as one example, if a vehicle had been in a crash necessitating the replacement of the passenger side frontal air bag.

In the event of a crash necessitating deployment of the passenger's frontal air bag, the inflator could rupture with metal fragments striking and potentially seriously injuring the passenger seat occupant or other occupants.

Owners of all vehicles on which a defective air bag may have been installed either as original equipment, or as a replacement, will be notified.

Dealers will inspect vehicles, and where a defective air bag inflator is identified, the inflator will be replaced, free of charge. The recall is expected to begin August 11, 2014.

Nissan recalls nearly a million vehicles with airbag software problems

Nissan North America is recalling 989,701 model year 2013-2014 Altima, LEAF, Pathfinder, and Sentra, model year 2013 NV200 (aka Taxi) and Infiniti JX35 and model year 2014 Infiniti Q50 and QX60 vehicles.

In the affected vehicles, the occupant classification system (OCS) software may incorrectly classify the passenger seat as empty when it is occupied by an adult. If the OCS does not detect an adult occupant in the passenger seat, the passenger airbag would be deactivated.

Failure of the passenger airbag to deploy during a crash (where deployment is warranted) could increase the risk of injury to the passenger.

Nissan says it has not received any reports of accidents related to the problem, and that the recall affects only vehicles sold in the U.S., Canada and Mexico.

Nissan recalling Frontier trucks to fix fire risk

Nissan is recalling about 13,000 Frontier pickup trucks from the 2012 through 2014 models year, the National Highway Traffic Safety Agency (NHTSA) announced.

The agency said it's possible a circuit breaker was improperly installed, which could lead to a short circuit that could cause a fire. 

The problem came to light after a consumer in Mexico reported smoke in the cabin of his truck.

Nissan said it doesn't know of any accidents resulting from the problem. 

Owners will be notified when the recall begins in March.

Infiniti Q50s with Direct Adaptive Steering recalled

Nissan North America is recalling 23 model year 2014 Infiniti Q50 vehicles equipped with Direct Adaptive Steering.

The affected vehicles received a power steering software version that, should the engine compartment reach freezing temperatures, the power steering software may disable the electric steering system and also may delay the engagement of the mechanical steering backup system. The disabling of the steering systems could result in a loss of steering, increasing the risk of a crash.

Nissan notified owners and arranged to have vehicles towed to the nearest Infiniti retailer. Customers were instructed not to drive their vehicles until they were repaired. Nissan Cube problems derail mother's quest for her daughter's killer

Dr. Maggie Zingman has been seeking justice for nearly a decade, but now her pursuit may be derailed by something as seemingly mundane as car trouble.

In late September of 2004, Zingman’s daughter, 18-year-old Brittany Phillips, was murdered in Tulsa by an unknown assailant. Since then, her mother has found a unique way to seek the public’s help in tracking down the killer.

Brittany, a student at Tulsa Community College, was raped and strangled in her second-floor Tulsa apartment. Her body was found three days later and she was buried on her 19th birthday. Police have DNA samples that they believe were left by the killer but have no active suspects whose DNA matches the sample, according to local news reports.

Zingman is a psychologist in Chandler, Okla., a small town located between Tulsa and Oklahoma City whose official motto is “The Best-Kept Secret in Central Oklahoma.” She has spent years travelling the country on one-woman “caravans,” driving first a Toyota RAV4 and, since 2011, a Nissan Cube, both covered in a vinyl “wrap” featuring pictures of her daughter and a description of the killer’s profile.

“It was [inspired by] the frustration of at first just standing on a corner… passing out fliers, and then trying to have stuff on my car that would get people talking,” Zingman said.  “[The wrap] just draws people in.” Since beginning the project in 2007 with the Toyota, Zingman says she’s traveled 67,000 miles to 46 states and talked to more than 100 reporters.

Cube issues

Recently, however, Zingman said her Cube has had mechanical issues that may ground it long-term and short-circuit her campaign.

A few weeks ago, “it started making a rattling noise,” Zingman said. She brought it to her mechanics, who initially thought that the problem was with the transmission, which she had already replaced once. She has since discovered that the car needs a catalytic converter and may have other issues. Zingman’s car troubles have forced her to postpone what was to be her 12th and final caravan.

“It just seems like [Cubes] have so many problems,” Zingman said. “It’s been more than a year [since the last caravan] and it just kills me when I can’t get out there.”

According to Zingman, when she initially brought her Cube in to her mechanics, “they had never seen any,” but since then, three more have been brought in. “I don’t know if [Cubes] are starting to get to the age where they’re doing it more,” Zingman said.  “Not a lot of people own this car. You still don’t see it a lot here in Oklahoma.”

But it's not just in Oklahoma that Cubes are getting to be a familiar sight in repair shops, according to Internet postings reviewed by ConsumerAffairs. Many of the posted gripes deal with the little car's continuously variable transmission, or CVT -- a shiftless transmission that is supposed to provide better fuel economy than the traditional transmission that has a fixed number of gears.  

“So here I am again a year letter getting yet another transmission. And my Cube was second in line to the other Cube getting a new transmission,” said a poster called Shanoree of Killeen, Texas, on CarComplaints.com.

“Needed a new transmission within a year,” said eal802 of New Haven, Vt. “They covered it under warranty but the dealership I have to use that I bought it from is horrible.”

Consumers rate Nissan

Over at JustAnswer.com, transmission specialist Glenn Bradley replied to questions about the Cube CTV with the observation that while standard transmissions have been around for 100 years, the CTV is still new technology.

“My experience with CVT's is that they have a high failure rate and are yet to be proven as reliable as regular automatic transmissions which were designed in the early 1900's,” he said, adding that Nissan has not been very forthcoming with information about the problems.

“Nissan are very closed on the subject and because of this the dealers are mostly just saying that in 2011 the transmissions have been updated," Bradley said.

Adding to the deafening silence, Nissan representatives did not respond to multiple telephone requests from ConsumerAffairs seeking comment on this story. 

Bradley, meanwhile, cautioned readers not to put too much faith in the replacement trannies. 

“It's hard to know how long the 'updated' transmission will last as they are still too new to be proven,” he said. “One thing to keep in mind is that the upgraded CVT warranty of 10 years/200,000km applies from the date of purchase of the car when new, the warranty on the new transmission does not re-start from the date it's installed.

Caravan sidelined

Zingman’s issues with her Cube may have farther-reaching implications for her as well. “These additional problems also make me unsure if I can take the job I was offered… it is better pay but it is 2 1/2 hours from my home. I might have to commute 240 miles round trip, 5 days a week,” Zingman said in an e-mail. “I cannot afford to let this car die. But I am unsure if I can afford to drive it that many days that far.”

Zingman says she has made contact with a Nissan representative to talk about the transmission issues. If the discussion isn’t fruitful, Zingman says she “tends to sometimes go up the ladder, which I may do, depending on my conversation with her.”

Zingman said that the fate of her car, and thus her caravan campaign, remains uncertain. “Although I still dream that I could do caravans year round, telling her story, I accept the toughness of being able to raise funds to do it full-time,” she said in an e-mail. “After the last 4 weeks, I am just praying I can do one more before the car dies.”

Nissan is recalling 19,258 model year 2013 Pathfinder and Infiniti JX vehicles manufactured December 3, 2012, through January 29, 2013.

The front brake torque member was improperly cast resulting in structural weakness, which could lead to premature failure and cracking. Nissan is recalling about 2,180 model year 2013 Titan trucks manufactured from January 22, 2013, through February 20, 2013; and model year 2013 NV vehicles manufactured from December 17, 2012, through February 20, 2013 and equipped with steering column-mounted transmission shift levers.

Nissan is recalling 13,919 model year 2012-2013 Altimas manufactured from May 10, 2012, through July 26, 2012. The vehicles may have been equipped with transverse link bolts and power steering rack bolts that were not torqued to proper specification.

Suit Charges Nissan Covered Up Brake Defect Since 2004

A federal class action claims Nissan has sold cars with defective delta stroke sensors, a brake mechanism, since 2004

In their suit, filed in U.S. District Court in San Francisco, Brandon and Erin Banks say that a defect in the delta stroke sensor, an electronic component that controls critical safety aspects of braking, causes drivers to lose braking ability without warning.

The plaintiffs claim that as a result of the defect, Erin Banks drove through a red light at a busy intersection with her two small children in the car.

"Despite applying the brakes in a manner reasonable anticipated to bring the vehicle to a complete stop, she frighteningly and dangerously went through the intersection," the suit alleges.

The suit seeks to represent all U.S. consumers who currently own Nissan products with the allegedly defective component and those who previously owned one, excluding those who claim to have suffered personal injuries as a result.

Nissan Armada

The Banks, who live in Placer County, Calif., say they bought a 2004 Nissan Armada in October 2006, when the truck had about 23,000 miles on the odometer. They also purchased a Nissan extended warranty that covered the vehicle for 75,000 miles.

On Feb. 24, 2011, as Erin Banks approached a red light at 40 miles per hour, she applied the brakes but the vehicle did not slow down. She pumped the brakes but still coasted through the intersection, the suit says.

The Armada was taken to Future Nissan in Roseville, Calif., and inspected. A service technician advised that the vehicle had displayed a test code which indicated a failure of the deltra stroke sensor in the ABS control unit.

The technician said he had seen the problem in a number of other vehicles, the suit charges, and said that Nissan had issued an update but that vehicles were being return for repairs even after the update had been applied.

$1,000 bill

The only way to fix the problem was to replace the sensor at a cost of more than $1,000, the technician advised, but the dealership declined to do so under warranty and referred Banks to Nissan's customer hotline, the suit stated.

After numerous phone calls, Nissan declined to pay for the replacement, allegedly stating that the warranty had expired and implying that Banks was not a "loyal" Nissan customer based on the number of non-Nissan vehicles he had owned.

Banks then spent $967 to have the sensor replaced at his expense.

The suit quotes Nissan Technical Service Bulletin NTB06-040 which describes the problem and outlines steps to remedy it.

Banks charges that he would not have purchased the Armada or the extended warranty had he known of the safety hazard allegedly posed by the faulty sensor, and charges that Nissan denied customers information that could have affected their safety and that of others on the road.

The suit seeks damages, legal fees and injunctive relief.

The company said some lower control link assemblies might not be properly welded. If the weld separates, vehicle handling could be affected, possibly causing a crash.

Nissan Settles GT-R Class Action


Nissan has agreed to replace the so-called launch control on its high-end GT-R sports coupe, bringing to an end a saga that started with one owner's truly horrifying story.

In October 2008, Autoblog reported that a GT-R owner took his car to the dealership after hearing loud noises in the rear end. The verdict? His transmission was finished, which Nissan said was the direct result of turning off the car's vehicle dynamic control, or VDC.

The owner had apparently disengaged the system several times in order to activate the Nissan's launch control, which allows the car to shoot from zero to 60 miles per hour in 3.3 seconds (versus a flat 4.0 with launch control turned off).

Nissan informed the owner he was out of luck, as GT-R's owner's manuals warn consumers to never turn off VDC unless trying to extract their car from the snow or mud. He would have to pay the repair costs himself, at a grand total of $20,000.

Much was made of launch control when the GT-R debuted in the States last year, and for good reason. Sixty miles an hour in four seconds would be more than satisfactory for most people, but the GT-R is an enthusiast's car; 3.3 seconds puts it ahead of the Tiptronic version of Porsche's 911 Turbo (which reaches 60 in 3.4 seconds) and even a good number of motorcycles.

Under the settlement, consumers are eligible to upgrade to a new-and-improved launch control (appropriately named LC2), which provides safeguards to reduce the likelihood of any more five-digit mechanic bills. Once GT-R owners upgrade, their warranties will be extended to five years or 60,000 miles, whichever comes first.

In spite of the new system's improved technology, however, consumers whose transmissions fail as a direct result of VDC being turned off will still not be covered.

If a consumer turns VDC off, then back on, and subsequently experiences a failure, the burden is on Nissan to prove that the VDC's disengagement was the cause of the problem. And it's not necessarily easy to game the system; Nissan has previously used black box data to determine whether problems were caused by the owner turning VDC off. 2009 GT-R owners will also get a service coupon worth $75.

The GT-R was launched in Japan in late 2007 and burst onto the American scene the following year. While Nissan has had some hits with enthusiasts before including its 350Z coupe the GT-R was the company's first American offering designed to compete with European supercars.

At a starting price of $80,790, the GT-R is not cheap by conventional standards, but pitted against, say, a Maserati GranTurino at $117,500 it's a downright steal. It also competes favorably with the 911 Carrera, which starts at a similar $76,300, and, in base form, is nearly a full second slower to 60 miles per hour. Time is money, after all.

Nissan Recalls 2007-2008 Sentras

Nissan is recalling 169,202 of the 2007 and 2008 model year Sentra because the brake master cylinder might leak fluid, according to the National Highway Traffic Safety Administration (NHTSA).

"The internal seal groove in the body of some brake master cylinders may allow for a gap in the in the groove contact areas of the seal. This may result in brake fluid slowly leading from the master cylinder into the brake booster assembly, causing the brake warning light to illuminate," NHTSA advised.

NHTSA warned that if consumers ignore the lamp, "one of the brake circuits on the vehicle may not operate as designed increasing the risk of a crash.

Nissan dealers will inspect the braking system on the Sentra when the recall begins July 23.

If brake fluid is found to be leaking, Nissan will replace the master cylinder free of charge.

Nissan and Infiniti Recall 16,000 SUVs

Nissan is recalling 16,365 Murano and Infiniti EX 35 SUVs to fix a software program that may cause passenger air bags to fail.

The recall affects 11,511 Muranos from model year 2009 and 4,854 Infiniti EX35s from 2008, according to a February 12 letter from Nissan to the National Highway Traffic Safety Administration (NHTSA).

NHTSA reported on its web site that the software problem could result in the passenger air bag not inflating in a crash increasing the risk of injury if the vehicle battery is significantly discharged.

Nissan dealers will reprogram the air bag control unit when the recall begins.

Mitsubishi Endeavor Recalled for Dangerous Seat Belt

Mitsubishi is recalling 7,340 Endeavor SUVs because the right side lower seat belt anchor may break off during a severe crash.

Breakage of the mounting bracket in a severe crash could allow the seat belt to not properly restrain the passenger and potentially result in injury or death, according to the National Highway Traffic Safety Administration (NHTSA) recall notice.

Mitsubishi dealers will replace the front passenger side seat belt and bracket assembly free of charge when the recall begins in February.

Nissan Recall Expanded to 654,000 Sentras and Altimas

Nissan Motor Co. is expanding a U.S. recall of Sentra and Altima sedans to repair a defective crankshaft sensor in 2002 and 2005 to 2006 models. The faulty sensor could cause the engine to shut off.

Nissan reported to the National Highway Traffic Safety Administration that the recall covers about 653,910 vehicles with 2.5-liter engines.

The sensor's location may expose it to temperature changes that would interrupt signals the sensor sends to the engine control module, according to Nissan. Without those signals, the control module may shut off the engine in low-speed driving, Nissan said.

Nissan Sentra Recall Announced


Nissan is recalling 276,000 Sentras to replace a faulty engine part. Recalls by General Motors and Ford were also announced by federal regulators.

The Nissan recall covers Sentras built between January 2000 and March 2003. A piece of foam insulation in a box housing the engine computer can emit sulfur, possibly causing corrosion in the computer that can lead to rough running or stalling engines.

Nissan will also recall 24,300 Infiniti FX SUVs to fix a brake caliper bolt that can come loose, leading to brake failure or a flat tire. The recall covers FX35 and FX45 models built between November 2002 and July 2003.
