On Dec 11, 2010, I Michael **** and my wife Liliya purchased a 2002 Audi TT, a 2-door black from the above stated individual and paid cash for the car. I paid $100.00 Estimate License Fees, $15.00 Registration Fees and until this date, he has sent nothing to DMV. I called yesterday and spoke with Juan and he stated that Martin is on vacation in Mexico and did not know when he will be back. He also stated that he has to sell another car before he can take my paperwork to DMV. I then left my phone number and e-mail address with him. I also filed a complaint with the Police Department where they stated that I am not the only one in this boat. I also filed a complaint with the Better Business Bureau. I cannot drive this car until the fees are paid which I already paid for in December, 2010.
My current financial commitment is to Credit West Corporation, account number A4043 40xxxx for $388.08 per month. On July 8, 2010, I took the car to the seller mentioned above for the reason that the vehicle was having mechanical problems. The seller stated that the vehicle was no longer their responsibility and that they had no further obligations to resolve any mechanical problems and I needed to to deal with the lender and no longer with the seller.
The reason I'm contacting you is because I feel I was taken advantage of being a first time buyer and 19-year old female. I have never been exposed to the experience of buying a car. The initial problem started the following day of the purchase, July 4, 2010, when the vehicle did not start up and I assumed it was the battery. Therefore, I got the battery recharged and it did start the car back up for the rest of the day. The following morning of July 5, 2010, the vehicle gave the same problem. At this point, I contacted the seller and spoke with Sales person Enrique R. to advise him of the problems. He stated there was no appointments available to have the vehicle brought in for diagnosis and repair and they will call me back when there will be an opening.
Meanwhile, I did not attempt to operate the vehicle and I repeatedly called them back everyday up to July 8, 2010, when I decided to take the vehicle in whether they had availability or not. The vehicle started back up again by giving the battery a jump to transport it there. R. told me that they still did not have available appointment to diagnosis my vehicle and refused services. Feeling powerless, I took the vehicle back home by jump started it once again and continued calling them back everyday up to July 19, 2010. On this date, R. did accept to diagnosis the car and stated they would conduct any repairs needed when they had time.
On July 20, 2010, I received a call from R. stating the vehicle was repaired and ready for pick-up. When I arrived there to pick up the vehicle, it would not start again. I requested an explanation for why the same problems was still occurring and R. appearing upset stated we do not know the problem with the vehicle and advised that they will look into it again and give me a call back. The next day, July 21, 2010, I received a telephone call from R. advising the car was repaired and ready for pick-up again. When i got there, the vehicle would still not start.
At this time, I got very frustrated and requested to cancel the vehicle purchase and receive my down payment of $3,500.00 back. R. stated that the contract cannot be canceled since the Credit West Corporation now held the title of the vehicle. R. also stated that they will not refund my down payment or touch the vehicle for repair again since its no longer their responsibility. I sent a letter to Credit West Corporation explaining the situation. Credit West contacted the seller and requested to cancel the contract and to refund the money back. Super Amigos Auto Plaza call me and requested the car key. The keys were given to them, no cancellation on writing was given to me or I did not sign any documentation. The car is already on sale again and they do not want to give me my $3,500 deposit back.
Please advise me of further actions i can take to resolve my situation. I also give rights to my older brother Humberto to communicate with you if I'm not available.
