Russell of Oklahoma City OK (11/01/07) I ordered from Berkeley Nutracuetical the free sample of Enzyte. I received it, and then a few days later received another bottle. I was unhappy with them for I also was billed $75.00 on my account. I attempted to contact them via their website, and it automatically tries to forward you into placing another order. My wife has attempted to cancel the order but they stated that I would have to do it. She is also on my bank account and has every right to cancel anything that I did not want.
I am out the money they automatically charged.
Ron of Bedford KY (03/16/07)
I called 800 number and ordered a free trial. I tried it for 2 weeks with no results at all called back said I didn’t want to continue and they already billed me for another order. They never credited my account.
Tran of Santa Clara CA (03/14/07)
I ordered their free 30 day supply of Enzyte and agreed ONLY and SPECIFICALLY to pay for their ONE TIME shipping charge. My Checking Account was withdrawn automatically less than a month later by their company - however no product was shipped to me. I cancelled all relations with the company - they never shipped any more product, but stole $70 out of my checking account which I am appealing with my bank as wire fraud. I never signed up for any automatic refill program nor did I approve anything but the one time shipping charge.
Bethany of Smithton PA (02/22/05) I purchased a full 12 months’ supply of Avlimil and a full 12 months’ supply of Rovicid, with the first order placed on October 30, 2003 and the final order placed on September 8, 2004 via the telephone. My decision to purchase these products were based upon their offer of a 12 month satisfaction guarantee. My purchase of the products constituted my acceptance of their offer, creating a binding and enforceable contract between us. I was not satisfied with their products. They did not work for either my husband or myself.
Due to the cost, I called to cancel the program of Rovicid on December 4,2003. I spoke with one of their operators, Lisa. Lisa told me she would give me the better price of 3 months for $66.00 and I accepted. She also told me that every time I need to order the Rovicid or Avlimil to ask for the special price and that she would make a note in my file. So, that is what I did. I was never informed that, by their company’s standards, it is considered a product upgrade. That was never made clear to me nor was anything about the lesser cost of the products effecting the guarantee. I was only told that it was a special price.
Their guarantee states, “guarantee will be nullified should the customer accept new product offers or product upgrades…..”. This nullification statement is unclear and ambiguous. It is not clear whether the word “new” modifies “product” or the terms “offers” and “upgrades.” The way it is worded it could mean either. Because it is worded that way, they have a legal obligation to uphold their satisfaction guarantee promise exactly as it is written at the time of my purchase. Due to the nature and type of products that their company sells, I thought it referred to new products. For instance, switching to Enzyte instead of Rovicid (which at the time that the Rovicid was originally ordered, it was advertised for similar reasons as Enzyte is advertised for now.)
I am owed $471.95
Jodi of Wood Dale IL (09/28/04) My son ordered their product , enzyte, a male enhancement drug from his college dorm. It was meant to be a joke, and unbeknownst to him he had signed up for a supply to come every sixty days, which they will so kindly take out of your checking account , automatically. He received his sample bottle, and then never received the second shipment.
After I had realized what he had done , we cancelled this supposed subscription, and tried to get our money back for the second shipment , they refused, and tried to tell me they would send out another shipment, which I told them I did not want. Needless to say , I am now minus 69.95 for the shipment I never received.
John of Joplin MO (09/20/04) They offered a free sample of enzyte. Just pay the shipping. What they don't tell you is that you are auto enrolled to have $79.95 a month taken from your checking acount without your authorization.
Brian of Parma OH (05/11/04) I ordered a free sample of enzyte. I found out that I actually ordered a one year supply with out my knowledge. I just wanted the free sample. They charged my credit card without my written consent! I did call the company The rep. did cancel future orders but would not give me back a refund. even though on the letter ti states if you have received this in error call customer care. I feel this was a gimmick and a fraud. When I received the free sample I did receive a order form saying if I wanted to continue ordering the product I was to call a tol free number. I feel I do deserve a refund.
Terry of West Hollywood CA (04/10/04) After hearing about the free sample offer ($4.75 for shipping)for Enzyte on tv, I ordered my free sample on the website in January. Unbeknownst to me, when you order you are automatically signed up to receive periodic supplies that are automatically billed to your credit card. When I finally figured out the scam, it was to late. They had already billed me $70.00.
Stephen of Jonesboro GA (01/05/04) I was pleased to read your article of the female breast enhancement pill maker being sued. Why can't a similar action be brought against the male enhancement pill sellers--like Enzyte. I have never purchased the pills, but it is advertised ad nauseum on mainstream TV shows and radio programs which I am watching and listening to with my children.
The medical newsletters to which I subscribe all say that it does absolutely nothing and has no value. Is the only requirement to beat a fraud claim with the FTC or whoever, that the company offers a full refund? Surely, most adults see this as a numbers game--a sufficient number of people will either be fooled or too embarassed to seek a refund.
