We are currently disputing two charges to our credit card - one charge for $139, and one charge for $100. The reason for the dispute is that we blindly signed a contract with this company for one year's service, while we thought we were signing a contract for a trial-basis, as we were told on the phone by Mr. K (he told us to ignore what it said on the contract, as it would not apply to us, we would be on a trial basis).
This sales person tenaciously called us at least 10-20 times a day, badgering us to sign up with their company. To get our business, he made us all sorts of promises, which led us to sign this contract hastily. Upon further investigation, we were told by a friend that we were getting ripped off. We also saw that there had been a previous complaint against this company through the BBB.
Consequently, we notified them immediately that we wanted to terminate our contract, before they had provided any real services for us. They contacted us upon receipt of our written notice of cancellation, saying that we were bound by the so-called contract. They proceeded to charge us for two months service on our credit card, even though we told them we want our logo taken off their website -- which they have not removed.
Some of the promises were the following:
- We would be featured on their front page;
- Contract was on a trial basis; we could cancel anytime we want to;
- They would be doing some heavy advertising to promote awareness of Dealz.com, giving us more exposure;
- We could expect up to 100 phone calls/orders a month.
None of the above has occurred. We are not on their front page, they won't let us out of the contract, they have done little to no advertising, and we have not gotten a single phone call or order through them.
Eldad is not going to last long as a businessperson if he doesn't start reading contracts before he signs them. We don't doubt that he's being skinned but unless Mr. K. held a gun to Eldad's head and made him sign the contract, it may be difficult to cancel it. Eldad needs to see an attorney.
