We read and hear a lot about drug companies being over-regulated by the FDA and other government agencies. These claims are debatable at best. What's more important for the consumer to understand is that non-prescription (also called "over-the-counter" drugs) and nutrition supplements are under-regulated.

It is not at all uncommon to find drug manufacturers making misleading claims or exaggerating the ingredients their particular product contains.

For example, certain makers of Melatonin supplements claim that their tablet contains a specific amount of melatonin, when in fact it contains a much smaller amount -- or even none at all. Obviously, if you knew this you would not buy the supplement.

Likewise, there are products that expose you to undisclosed risks. Again, if you had known this you would not have taken the product.

While there is, unfortunately, inadequate regulation of such substances, you are not totally without recourse. Each of the instances cited above could constitute actionable fraud -- meaning that you could sue the manufacturer.

If you have reason to believe that an over-the-counter drug or nutrition supplement did not contain what it claimed to, has harmed you or has not delivered the benefit that was promised, contact us immediately -- and be sure to save the package and contents.
