Irma of La Puente, CA, writes:
On March 12, 2001 before 1:00 p.m., I called the number provided by a co-worker and inquired about their product, NONI JUICE. The receptionist took my telephone number and around two to three hours later Daniela told me about their current offer for purchasing Noni Juice, which is a curative juice to help with blood circulation, immune system, etc. I asked her about the autheticity of the product they are selling, since I was not interested in obtaining a reproduction or a synthetic product. She explained they guaranteed the authenticity of their product and insited on taking the order and they deliver later if I wanted. I told her that I will call back until I decided if other members of my family will interested in ordering their offer of 'Purchase 3 bottles for $149 with No Tax and obtain an additional 3 free bottles'. DAniela insisted that she could take the order and they could deliver until Thursday, March 15th, 2001 between 5:00 pm to 7:00 pm. I said I will pay cash. During this conversation I was never notified that I was entering into a contract and that they would not accept cancellations. I took an hour lunch and the same day around 2:20 p.m. (in less than 3 hours that I had called them) I called to cancel order since a co-worker mentioned that their juice is bottled in a plastic container and not in the glass container. I knew from other resources that the original Noni juice comes in a glass container. This is the reason I decided I wanted to cancel. I called the number again and asked to talk to Ms. Daniela who took my order and that I needed to cancel. The receptionist then mentioned that they do not accept cancellaltions and that I had entered into a contract. Therefore, I had to buy the product now. I told her that at any moment they mentioned a contract or that no cancellations were accepted. Since she did not wanted to refer me to anyone, I told her that I was going to report them to the Consumer Affairs, since they violated my consumer rights. Today, March 14, 2001 at approximately 11:00 a.m. a Mr. Alfonso of California Express called to notify me that he was going to deliver the Noni juice between 5:00 p.m. to 7:00 p.m.. I explained to Mr. Alfonso that I tried to cancel the order in order to stop shipment of this product, however, the company did not want to accept my cancellation and that I was referring them to Consumer Affairs. He said that he did not care wether I report to you or Mr. Bush, that I have to pay him shipment and delivery charges and he was notifying me of this. I told him that he just made me aware of this charge and that I will not pay or accept merchandise. He insited he will deliver.
