Consumers who sued Comcast claiming it markets and sells service plans without disclosing additional equipment fees didn't get much sympathy in a federal courtroom in Oakland.
Lead plaintiff Athanassios Diacakis said Comcast offered him numerous deals over the phone, including a Triple Play package that bundles cable, phone and Internet services, without mentioning the additional fee to lease a modem.
But U.S. District Judge Saundra Brown Armstrong said the plaintiffs' complaints didn't "pass muster" and dismissed most of Diacakis' claims, Courthouse News Service reported.
"The [complaint] fails to specify when or where Comcast advertisements were viewed, the content of those advertisements, or which of them in particular Plaintiff relied upon," Armstrong wrote.
All is not lost, though. Diacakis and his lawyers can try again by filing an amended complaint.

FOS is false, Blazing fast internet YEAH RIGHT! "their repair dep HAS NO TECHNICAL COMPETENCE AND ABILITY TO FIX INTERNET QUALITY.
