Missouri consumers who had their evening meals interrupted by telemarketers pitching vinyl siding were not amused, especially since many of them were on the state's Do Not Call List.
Their complaints to Missouri Attorney General Chris Koster has resulted in a temporary restraining order against C. Michael Exteriors, Inc., a New York-based telemarketing company.
Koster obtained the injunction while we waits for his suit against the company and its owner, William Bergmann, to be heard in court. The lawsuit alleges violations of the Missouri Merchandising Practices Act and the Telemarketing No-Call List Act.
Koster said telephone solicitation calls were made to consumers in the St. Louis metropolitan area attempting to sell windows and siding.
“When Missourians register with our No-Call list, they do so with the reasonable expectation that they will not receive these unsolicited, harassing calls,” Koster said. "These businesses are aware of our No-Call laws, and they are realizing that this office will enforce those laws.”
In its ruling, the court specifically ordered the company to stop making calls to consumers on the no-call list.
Marilyn Leiker (Wed, 17 Aug 2011 17:07:13 +0000): It's too bad that the State of New York consumer affairs office can't stop companies like TruGreen from harassing phone call to former customers. We had at least a dozen calls last spring, and each time either my husband or I asked not to be called. They called again and again. I couldn't even find an office of consumer affairs in the phone book. Finally, after I said I would do something legally to stop them, the harassing phone calls stopped. Missouri has a better consumer affairs department than New York State does.
