Texas Woman Claims TRESemmé Fresh Start Shampoo Set Hair on Fire

Lawsuit seeks damages from Alberto-Culver USA for alleged failure to warn of hazard


photoA Texas woman has sued Alberto-Culver USA, claiming her hair ignited when she lit a cigarette after using the company's TRESemmé Fresh Start shampoo.

Venetia Sundance filed the suit in the Brazoria County, Texas District Court and said she was a resident of Brazoria County when the incident occurred on Oct. 28, 2010.

Sundance said she applied the waterless foam shampoo according to the directions. A few hours later, she lit a cigarette and the product ignited, causing severe burns to her head, ears, eyes and face.

The suit charges that Alberto-Culver “failed to use reasonable care” in manufacturing the product and negligently caused Sundance's injuries by failing to warn consumers of the potential hazards associated with the shampoo.

The company's Web site makes no mention of any fire danger. Its “How To Use” instructions say to shake the can, lightly spritz the hair's roots, leave the product in for 1-2 minutes, brush the hair to remove excess and style as usual.

Sundance seeks compensation for medical expenses, physical disfigurement, lost wages and physical pain and mental anguish. She is represented by W. Mark Lanier, a Houston attorney.
