Junk Fax Suit Seeks Big Bucks

A New Jersey company that blasted unsolicited faxes into Indiana homes and businesses is the target of a lawsuit by the state. Indiana Attorney General Steve Carter says his office received more than 1,000 complaints about EZPMG, Inc. faxes.

"For each fax brought to our attention, it is likely there were hundreds more that were unreported and caused headaches for people across the state," said Carter. "We have heard from citizens in 51 counties who were supplementing the advertising costs of this East coast company thousands of miles away. One person in Pulaski County received as many as 200 faxes alone."

The attorney general's office received complaints from across the state about EZPMG faxes that were sent over an 11-month period from January, 2007 thru at least November, 2007. The faxes advertised mortgage services.

Carter is asking the court to halt EZPMG from violating Indiana law by sending unsolicited faxes. The lawsuit also seeks civil penalties of up to $1,500 per violation against EZ Precious Metals Group Inc. d/b/a EZPMG, Inc., and its president Kenneth B. Elias and another $10,000 for the company's failure to obtain a certificate of authority from Indiana to transact business within the state.

The lawsuit has been filed in St. Joseph County, Indiana Court.
