On January 28, 2010, I spoke with representative, Divya, from Law Offices of Mitchell N. Kay, P.C. I informed her I wanted to pay thru debit card a Chase account I owed. She informed me of the total ($387.83). I told her I wanted to pay the settlement they offered. She then informed I could settle for $155.13. She said I would have to pay by credit or check. I said I would call her back with the information.
On February 8, I called their offices to give my bank account information and spoke with representative Pish (5:12 pm). I asked if I could speak with Divya. He informed me he needed my information. After giving him my information, he began to tell me the total amount I owed. I told him I spoke with Divya and wanted to pay the settlement amount for $155.13. He said okay and how I will be paying. I began to give him my dad's card information. He informed me he would have to speak with my dad. I said I will call him back with my father. He informed me that I would have to call back today or I'll lose out on this settlement offer.
I called my dad and we called Pish back (5:35 pm). My dad then spoke with him and began giving his account information. He then began telling my dad he would have to pay more than what we agreed upon. I asked to speak with a supervisor. Pish got Gunther on the phone and I explained the situation to Gunther. Gunther began to say the $155.13 offered expired on February 7, 2010. I explained to him that no one informed me that it would expire on February 7, 2010. I began to discuss my conversation with both representatives to Gunther. He then informed me that he was going to call and find out if he could settle for that amount. He said he would call me back. I said to him will I lose out on this deal if you don't call me back. He then said he knows. I can call him as well.
On February 9, 2010, I get no phone call. On February 10, 2010, I called and asked to speak with Gunther. He said he had not heard anything and so I asked how long does it usually takes. He said a couple of days but he should hear something soon. I said okay. On February 12, 2010, I called and spoke with someone. I informed them I wanted to speak with Gunther; they said he was on a call. We went through whole routine of asking for my information. He said he could let me speak with another supervisor. I spoke with Al. I went back and forth with all. He began to say that the $155.13 settlement expired. I spoke with a woman and she was no help.
I asked her, "When did it expire?" She said, "2/10/10." I told her that could not be possible because I have a letter in my hand from 10/8/2009 saying you all will settle out for $193.92. She said they mailed out a letter in January. I asked her when because I never received a letter. I asked if she could fax that letter to me and of course she couldn't. I then asked her to send me a copy of my conversations with their representatives because no one said it expired. She said she would make a note. I asked how long does it take she said she wasn't going to make a promise. I asked to speak with Gunther. I asked Gunther if he did get any information back regarding the settlement. He said yes and he could not settle it out for that amount. I asked when he received this information. He said the day before yesterday which made it February 10, I asked why he didn't tell me when I called him and when he was going to call me. He said he told a colleague to give me a call; I informed him they didn't. I then said, "Never mind. I am going to call consumer affairs."
Please help me take care of this matter. Each time I spoke with an individual, they informed me that my phone call was being taped and I agreed to this. Our conversation with all representatives will show you something is not legitimate in how they handled my account.
