I work for a bank and had a customer that got a phone call from this (Law Office) as they explained to her that she owed a debt that she never had. The account number was not valid, they asked her for her Social Security number, address, etc. She was an elderly woman and fortunately, did not give her social, so anyway, I personally called to find out what it was about and of course, they want her information again.

They sounded like it was some type of call center (not a professional law office, that they claim) the lady had a heavy Indian accent and sounded like it was fraudulent for sure. These people need to be stopped, they are trying to get credit card numbers to pay for this (debt) that does not exist. This is just a warning because I know these people will do it again and hopefully they do not give information.

I am deeply upset and dissatisfied with Mitchell N. Kay's lack of customer service. Without my knowledge, T-Mobile sent a $35 collection fee to Mitchell N. Kay to process against me. Mitchell N. Kay failed to contact me personally despite having my personal contact information. I learned about the $35 fee from the Georgia (GA) Bar Committee since I applied to the GA Bar to obtain my license to practice law.

In order to sit for the bar exam and eventually obtain my license to practice law, the GA Bar Committee required that I obtain a satisfaction letter from Mitchell N. Kay stating that I paid the $35. After learning of this debt, I immediately contacted T-Mobile to pay the $35 fee because at this time, I did not know that Mitchell N. Kay were responsible for the collection. On April 6, 2010, after paying the fee using my debit card, T-Mobile gave me a confirmation number (No. **) to provide to Mitchell N. Kay to show that I paid the $35 and to obtain a satisfaction letter from Mitchell N. Kay.

Now, one may think that such a process would be easy: You call Mitchell N. Kay to provide them with the confirmation number to show that you paid; Mitchell N. Kay calls T-Mobile and validates that you paid; and then Mitchell N. Kay sends you a satisfaction letter. Easy, right? No! Not when Mitchell N. Kay is involved! After speaking to numerous alleged customer service "professionals" to no avail (including, Account Supervisor, Chad **), 15 days later, I have been informed that Mitchell N. Kay will send me a letter 30 days after validating that I paid T-Mobile, whenever that will be! Never mind that I have to take the Georgia Bar and that in order to do so, I have to turn this important information in by certain deadlines!

You would think that a law firm comprised of lawyers who have been through the process of applying to the Bar would be sympathetic to my needs by validating that I paid T-Mobile and processing the satisfaction letter immediately! But, no, not at Mitchell N. Kay! Furthermore, never mind that as I type, this ordeal is negatively affecting my credit!

I was contacted by telephone on more than one occasion about a debt I did not owe. They refused to give me the name of the company/person to whom this debt was owed but did want my SSN. I refused to give anything but my name and city. When I finally convinced them they had the wrong person, Raul said my name and phone number would be removed from their list.

I had received a notice in December of a debt owed of $766 for a credit card issued by a bank I had never heard of, nor did I ever own a credit card by that name. Upon calling the phone number provided, I was obviously dealing with a call center from India as I could barely understand the rep who answered the call, nor could he understand me. Upon discussion of this account with the rep, I learned that it was not my SSN was that used to open this account, and the rep said the file would be closed since it was a case of identity theft. I quickly checked my credit report and verified that this bad debt was not listed, which it wasn't. However, in February, 2010, I received another letter from this law firm requesting payment.

Again, I went through the entire scenario with the person I spoke with. This time, it was Dimple who again told me that the name, address and even my birth date on the account was in fact my information. However, Dimple gave me the SSN that was not mine as the number used to open the account. Again, I informed them that this was not my SSN, and I had never heard of the bank nor owned that credit card. Dimple assured me the case would be closed without any repayment from me.

After that call, I filed a police report for identity theft against Mitchell N Kay law offices and also intend to file a complaint with the FTC who monitors this type of identity theft.

Continuous voice mails left at my office, when I call to inquire they are very unprofessional and rude. They have hung up and have talked over me. They need to stop calling my office and my relatives.

On January 28, 2010, I spoke with representative, Divya, from Law Offices of Mitchell N. Kay, P.C. I informed her I wanted to pay thru debit card a Chase account I owed. She informed me of the total ($387.83). I told her I wanted to pay the settlement they offered. She then informed I could settle for $155.13. She said I would have to pay by credit or check. I said I would call her back with the information.

On February 8, I called their offices to give my bank account information and spoke with representative Pish (5:12 pm). I asked if I could speak with Divya. He informed me he needed my information. After giving him my information, he began to tell me the total amount I owed. I told him I spoke with Divya and wanted to pay the settlement amount for $155.13. He said okay and how I will be paying. I began to give him my dad's card information. He informed me he would have to speak with my dad. I said I will call him back with my father. He informed me that I would have to call back today or I'll lose out on this settlement offer.

I called my dad and we called Pish back (5:35 pm). My dad then spoke with him and began giving his account information. He then began telling my dad he would have to pay more than what we agreed upon. I asked to speak with a supervisor. Pish got Gunther on the phone and I explained the situation to Gunther. Gunther began to say the $155.13 offered expired on February 7, 2010. I explained to him that no one informed me that it would expire on February 7, 2010. I began to discuss my conversation with both representatives to Gunther. He then informed me that he was going to call and find out if he could settle for that amount. He said he would call me back. I said to him will I lose out on this deal if you don't call me back. He then said he knows. I can call him as well.

On February 9, 2010, I get no phone call. On February 10, 2010, I called and asked to speak with Gunther. He said he had not heard anything and so I asked how long does it usually takes. He said a couple of days but he should hear something soon. I said okay. On February 12, 2010, I called and spoke with someone. I informed them I wanted to speak with Gunther; they said he was on a call. We went through whole routine of asking for my information. He said he could let me speak with another supervisor. I spoke with Al. I went back and forth with all. He began to say that the $155.13 settlement expired. I spoke with a woman and she was no help.

I asked her, "When did it expire?" She said, "2/10/10." I told her that could not be possible because I have a letter in my hand from 10/8/2009 saying you all will settle out for $193.92. She said they mailed out a letter in January. I asked her when because I never received a letter. I asked if she could fax that letter to me and of course she couldn't. I then asked her to send me a copy of my conversations with their representatives because no one said it expired. She said she would make a note. I asked how long does it take she said she wasn't going to make a promise. I asked to speak with Gunther. I asked Gunther if he did get any information back regarding the settlement. He said yes and he could not settle it out for that amount. I asked when he received this information. He said the day before yesterday which made it February 10, I asked why he didn't tell me when I called him and when he was going to call me. He said he told a colleague to give me a call; I informed him they didn't. I then said, "Never mind. I am going to call consumer affairs."

Please help me take care of this matter. Each time I spoke with an individual, they informed me that my phone call was being taped and I agreed to this. Our conversation with all representatives will show you something is not legitimate in how they handled my account.

My mother who has paranoid schizophrenia and Alzheimers has been receiving threatening collection letters. She racked up a small debt, about $500, about 5 years ago prior to her diagnosis of Alzheimers. She was diagnosed and placed in care about 4-1/2 years ago. Her Social Security and SSI pay for her stay, $19 for her phone, and between $45-$55 or more per month for her medication copays. I settled this business long ago with the bank, but these people are harassing this poor woman, who gets calls and doesn't understand why and doesn't even remember the debt. I'm planning to call these people and let them know I've read all about them and the lawsuits and their scams and they can go jump in a lake.

Called to say that I owed $150 for a 2000 Honda lease. Thinking it was something that my daughter owed since I had signed for her lease I said that my daughter would pay. They in turn called my daughter in law (since she has the same last name and my daughter does not) looking for money but wouldn't give them any information so she called me and told me what was happening. I emailed my daughter and said to take care of this today....she gave them her checking account number to pay the debt without thinking too much about it. She then called me and I googled Mitchell N Kay and saw all sorts of bad things about this person and his law firm.

I told my daughter to stop payment on the check and to change her bank account so that he couldn't go after it. I spoke to a lawyer who had something on the Internet about Mitchell for wire tapping. When my daughter asked for documentation he said that she had already received everything, which we never have.

I have been receiving harrasing automated messages from a #877, ...Message is as follows: This is a personal message for Mr. ****Brown, please respond....It has been happening for months... I have called them, to tell them I am not "BROWN", but they continue to call...It is some collections, or debt. collector...I ahve read many posts about them, which identifies them as a "scam"...I want the calls to stop....

I recieved a notice from the Law Offices of Mitchell N. Kay, concerning a settlement offer. My credit report is clean - the law office is stating that I owe $2,763.53. I did owe Victorias Secret this amount 10 years ago and in fact we settled. I am concerned this is a HUGE SCAM since my credit report is clean. What do I do? I do not owe the money so I do not intend to call this company. If anyone can provide assistance I would appreciate.

Mitchell N. Kay Law Offices Has been Harrissing me and calling my parents phone number. They leave Automated messages and That is not a way to contact someone!!!!!!. They are very RUDE!!!!!!. Is this really a Law Office? I have been reading a lot of complaints about them. They don't speak english. I am very very close to sueing Mitchell N. Kay Law Offices For Harrassment!!!!!!. They Better stop calling my parents phone number.

I work in Afghanistan and my wife was contacted by this firm, via mail, harrasment phone calls @ home and work. The claim was that we owed $74.64 on a Texaco Credit card from the 1980's. My wife was also told this was reported on our credit report and she pulled the report and saw the claim. So, she paid the amount with out telling me; which I would have instructed her not to pay until I had researched the claim. When I noticed the payment, I asked her about it and then researched the company with has numerous compliants of fraudulent claims made as a scam to "Rip-Off" unsuspecting consumers. We have had to cancel our debit card and are filing a "Dispute Claim" with our bank. $74.64 and the worry of further withdrawels from our checking account.

I have been harassed via telephone by a representative of this company to pay a supposed debt to Directv whom this agency is acting for.
They, without properly informing me of how they have come to this assumption, have placed an adverse statement on my Trans Union Credit report, stating that I owe Directv, their client $504.00.


Bottom line, I moved in December 2008, and my account was paid current with Directv. The day that I called to cancel my service, they went into my bank account without my authorization, and withdrew $232.33 for cancellation and all other charges which should not have even been there.

I completed my contract with Directv, and have ALL of the statements from the time of my contract to the end, along with a receipt for the receiver which I bought, and they are saying I didn't but returned it to them anyway to avoid an issue.

This account is being bounced from one credit collection to another, and although no other has reported it, the agency of this complaint has deceptively placed a bad mark on my credit report.
I am 70 years old and in ill health, and this being harassed by phone at least 3 times a week is getting to me.
Please, I need resolution, before time deals with it.

These people called me last year saying I owed money to TMobile for a cell phone that I had owned ten years ago. The thing is, I'm from Ghana and I only came to this country five years ago, which I told the man on the phone, and he hung up. Then I did not hear from them again until I received a letter dated June 30, 2008 which stated that I owe T-Mobile $943.15. This is impossible. I have never had an account with TMobile. I don't have a cell phone and never had.

I've never received a bill from TMobile for this so-called phone, but now all of a sudden this credit agency is claiming I owe this money. I looked this company up on the internet and found that many other people have been victims of varying levels of fraud at the hands of the Law Offices of Mitchell N. Kay, P.C. I haven't yet seen my credit report so I don't know if they took it to the level of reporting this fraudulent account officially, but I am in the process of obtaining my report.

Someone is claiming I owe $943.15. I am scared that if I don't pay it, it will end up on my credit report--as has been the case for some other individuals writing about their experiences at forums on the web. and since I haven't seen my credit report yet, I'm not even sure if this hasn't happened to me as well.


Almost 2 years ago I got a letter from Mitchell n. Kay. Saying that I owe t-mobile around 300+. And they would settle it down if I pay half of it. But that time I call them and ask them if I can pay 50 now and the 100 dollars is on my next pay day. But they said no. so every month I keep on paying 20-30 dollars. And also every month they would send me a bill saying the get my letter and I should send my payment by the end of the month. Its been 3 months now and I was wondering why I didn't get a bill?

I call them and they told me that I wrote a check last April 5? But how can I write a check if I didn't get any bill right? I told him the last check I wrote was March 28. He also told me that my next bill should be arriving on May 5th. But up until now I didn't get any bill? So I wrote them a letter and I even email them saying my concern. But they didn't even bother calling or writing to me.

Today I called them up around 11am and the lady is so rude to me. And she connected me to another representative. But they hang up on me. Now Im so worried. Because I only have less than 100 dollars left of my debt which is 300+. Im so scared that I must have wasted my money for nothing. Now I don't know what to do. Please help me. I can't get in touch with them. I just want to pay off my debt to build my credit again.

I don't wanna call them again because they are so rude to me. I just wanna clear off all my debt. and i don't want my past payment to be wasted for nothing.

I was a member of Ballys in the year 1998. I could not afford it anymore and the account went into collection. There have been numerous collection agencies. Even though this account is no longer in my credit report because it reached statue of limitations. It has been over eleven years. Collections companies continues to try to get this debt paid however the statue of limitations for New York is 6 years for contract as well. Why am I continued to be harassed to pay for a service that I never utilized in the first place? Why are they are violating the statue of limitation. I am poor with disable parents to support.

I received phone calls and letter announcing they are lawyers, claiming they will make this debt valid. I don't have money, I have two disable parents to support.


He contacted me on 12/17/07 on my job about a balance that he said I owed and I had already paid $107.32 on a letter that was sent as a settlement notice. He stated that I owed them 80.00 more dollars because I sent it in 2 payments. He wanted me to do a post dated check and I told him that I would not do that he claimed that he had tried to fax something to me but I never received it.

So on 12/21/07 at 1100 am I received a fax letter from some one name Shaquana Morris, Asst. Manager of Collections perations. Which had a if I have any questions to contact Patrick Clarke and I still haven't spoke with him. I have spoken to an individual calling himself Mr. Brown and each time he has been very ruid.

On 12/28/07 I had my bank send out the payment of $80.00 to the same P.O. Box as my previous one and they claim they haven't received it. My bottom line I am tired of being talk to nasty and them calling my job so what can I do I'm not going to send them any more money.


The company I am writing about is the Law Offices of Mitchell N. Kay P.C.

I received correspondence from them saying they were attempting to collect on a Ballys debt. I had previously sent a dispute letter to the Collection Agency who initially contacted me about this debt called Asset Acceptance, LLC via certified mail. In the letter I stated specifically that I was disputing this debt and requesting validation. I know that Asset Acceptance received that letter because I have the proof of receipt of the letter from them. However, after sending this letter requesting validation. I didn't hear back from them again.

Then one day I had just come home from work only to be shocked when I opened a letter that I received in the mail and found out that it is from The Law Offices of Mitchell N.Kay P.C.

The letter I received from the Law Offices of Mitchell N. Kay appears to be some kind of settlement letter, but is regarding the very same alleged debt that I am currently disputing with Asset Acceptance. It looks like instead of ceasing collection and providing validation Asset Acceptance chose to move forward with collections anyway.

By contacting Mitchell N. Kay (who is a lawyer) it appears that this is a direct violation of the FDCPA laws:

I also did some research on Mitchell N. Kay and found out that Mitchell N. Kay is a lawyer who owns and operates this company. He also has been part of two class action lawsuits filed against him for deceptive collection practices and numerous complaints filed against him for engaging in unscrupulous collection activities.

Now I am worried because I am sending him a cease communication letter but don't know if in response to that he will try to threaten me or sue me. I don't know what he is capable of.
I also am wondering if they have deceitfully already went to court somehow behind my back and got a judgement on me without my knowledge. I heard they have done that to other people.

I am so tired of these bottom feeder agencies and Would like to know what to do next?

I have spent numerous hours writing dispute letters and I am physically exhausted. I have put out money to send certified letters only never to hear back from these people. I am not sleeping well because of this and fearful that these people will engage in deceitful behavior so that I am having my credit reports monitored 24 hours a day. I am putting out money for the monitoring and alert service so that I know what Mr. Mitchell and Asset Acceptance is up to and I am scared.

I have never been sued by anyone for anything. This is affecting me at work as well. I am always thinking about this situation. I am not an attorney and I don't know what to do to fight these people back.
