They did nothing except take $1,905.94 out of my account every month and they did not repay any of my loans. I experienced extreme mental stress and now, I have been subpoenaed to court on one of the debts that they are supposed to be dealing with.

There was another address and I contacted Louis back in October 2008. He sent me a contract and I was reluctant to sign but he reassured me that he could secure a modification with County Wide. Within only a few months, he told me to stop paying my loan. I was current at that time and he told me use house payment to pay them for their fee and they would be able to secure a modification within three months. I paid the $3495.00 and never received a modification.
I am out-of-pocket and afraid of losing the house. Due to the stress of this, I am separated from my husband and he lost his job.

My clients signed agreements with Gary Erickson to perform debt settlement negotiations with their creditors. My client recently learned that Gary Erickson shares offices and is associated with the Green Credit Solutions/Guardian/GetMyCreditGrade.com group who have had numerous complaints and a desist order filed against them for taking fees to negotiate mortgage loan debt but then not doing anything with the files and taking all the money provided to them in fees and spending it as it came in (loan mods) and Gary was their attorney. With Gary's knowledge, the owners of GetMyCreditGrade.com removed all cash from the loan mod fee account and stopped working on more than a 1000 loan mods in their pipeline the day SB94 passed. Gary has no experience settling debts per his bio and has civil actions filed against him recently in San Diego per a current ongoing blog of consumers/agent complaints against him and the people of getmycreditgrade.com (Chris and Curt).
Per an ex representative of Green Credit Solutions Gary Erickson receives all of his debt contracts from Green Credit Solutions/Guardian/getmycreditgrade.com and pays them all of the debt settlement fees he gets, as he gets them each week, from the debt settlement contracts in return for more contracts to be provided to him and his salary (except what he retains for his personal business expenses leaving nothing in reserves for the clients debt settlement contract which last anywhere from 36-60 months.) A current employee of getmycreditgrade.com provided this information. Green Credit/Guardian/Getmycreditgrade.com also provides Gary with the staff, and helps manage that staff, to work on the debt settlement contracts since Gary has no experience settling consumer debts (the same staff who created all the loan modification complaints and mishandled those files). When SB94 passed and Green Credit/Guardian/getmycreditgrade.com could no longer accept new fees for loan mods they let all their emplooyees working on the files go and told their agents they would no longer be working on the consumer files.
Many of those consumers had been sold Gary Erickson Debt Contracts based on false statements with Gary's ericksons knowledge and support (see other consumer affairs complaints posted on this site and Trulia blog) saying it would enhance their loan modification results with Gary's knowledge when he accepted the contracts. Per the ex representative of green credit, without any new income for green credit solutions/guardian/getmycreditgrade.comfrom new loan mod business and empty loan mod trust accounts, they (gary erickson and the owners of getmycreditgrade.com) all agreed to use the debt settlement fees being paid to gary erickson for debt settlement services to fund the salaries and expenses of the getmycreditgrade.com crew and support their ongoing misrepresentation they use to generate more debt contracts from the public and their agents. I also see on this site a complaint from an agent who said they stopped getting their debt settlement commissions, and the ex green credit rep said he stopped getting paid his commissions as did all of his agents (he has approx 10) too because Gary gives the agent commissions to the getmycreditgrade.com people instead - then they all vote each week what to do with the money and Gary makes the final decision who getmycreditgrade.com pays a commission to. (testimoney of this is available from a current getmycreditgrade.com employee per the ex green credit representative).
In light of all this information, my concerns are: none of the money coming in for debt settlement fees is being set aside and reserved for customers - - instead it is being used to buy more debt files from getmycreditgrade.com and fund their operation. Also, in my clients case, the Gary contract promised to notify my clients creditors and advised the creditors to call him vs. my client for collections but that never happened. My client has never spoken with Gary (but paid over $7,000 in fees so far which appear to have all been spent but no work has been done on her file towards the settling of any of her debts) nor have any of the creditors ever been contacted by Gary. As a licensed attorney, isn't [he] bound by some sort of Ethics Code in regard to:
1) how he obtains files (using his fees received for debt settlement to buy more contracts vs. reserving those funds for work he promised to do in the future on contracts that last 36-60 months)
2) ensuring files he accepts were not cohersed into signing his agreement based on a false promise or unrealistic expectation ("it will improve your loan mod results")
3) Not accepting files he knows were sold incorrectly?
4) not engaging and colluding with other businesses or individuals who are known to have committed violations and potential fraud and are continuing to generate ongoing consumer complaints and regulatory desist orders and investigations
4) making accounting and money handling decisions for another company that he knows violates that companies agreements with their agents (when he decides what getmycreditgrade.com does with the money he pays them and knows the decisions he makes violates agreements getmycreditgrade.com has with their agents) based on what will get him more contracts next month (ie. pay the agents who are still sending us new contracts vs. those who stopped).
What recourse does my client have and can she get a full refund? What about other clients in the same circumstance? The ex green credit employee has the names of dozens of clients and their agents in the same circumstance. What can we do?
