Lois of Blackwood, NJ, writes: On April 28, 1999 we entered in a contract to sell our home with a buyer that our realtor brought to us. May 28th we were to receive a mortgage commitment. These were the terms set by ERA Real Estate agent M.R. However since then we have yet to close on the property. On June 9, 1999 a message was left by Ms. R. that closing was supposed to take place at the buyers lawyer's office. We were given instructions to pack and move out of our home! The fact of the matter is that Mrs. R. had no commitment letter from the buyer's mortgage company stating that the buyer was approved for a mortgage. In fact it took the mortgage company three months to say no. We notified Mrs. R. that we would be moving on the 17th of June, and she said that it would be no problem and she was well aware that we would be moving. Since this has occurred F. M. of Superior Mortgage had found a new mortgage comany that was willing to provide the buyer with a mortgage if she qualified for the loan, but the buyer didn't return any of the mortgage company's calls. We have talked to real estate broker for ERA and have asked her for a letter stating the reason why we have not closed on our house yet, so that we can present it to our next mortgage company to explain the late payments on our mortgage. We have a pre approval for a building loan waiting on us. We have never been late with our mortgage the whole 5 years we were living there and now there will be blimishes on our credit for 7 years, all because we were told to move out of our home by our realtor. We are in an apartment now and cannot afford to pay a mortgage, rent, other miscellaneous bills, and save for our next house. We also spoke to J.G. of ERA to explain the situation and he said that we should be paying them $8,000 instead of $4,000 for all the hoops they are jumping through to get the buyer approved. We were apalled when he made that comment. In closing, my husband and I feel we were not treated fair in this situation, all we asked this realtor to do was sell our home, and they did nothing for us but dig us deeper in debt. I also have the message on our machine by the realtor stating that we were closing on the 21st of June, which she tried to deny and say she never told us to move out of our home. I have also reported them to the NJ Realestate Commission.
