Pamela of Brick, NJ, writes:
Paid deposit of $8000 to Mr. F to perform work on home recently purchased in Red Bank, NJ. Contract signed on or about September 7, 1999.

Promised to perform work since then, but has not shown up to do the job as of this date. In addition, the plans submitted to township were not approved. Never returns phone calls. I have given him plenty of opportunity, he simply does not correspond, connect in any way.

I have since fired him and he has yet to return my $8000, let alone phone calls. The man has promised and lied constantly throughout this work contract.

The home he was hired to work on has not been able to progress in any manner, because his work must be done first before we complete anything else. Therefore, since our contract signing on or about 9/7/99, the work has been at a complete standstill. SIX WEEKS AS OF THIS DATE.

What do I do now?

Well, we certainly hope Pamela's contract set some specific performance guidelines that this firm must meet. If so, she could go to Small Claims Court and perhaps get some of her money back.

But we don't understand why Pamela is still waiting for the elusive Mr. F. to come and work on her house since she says that she has fired him.

We know most people don't like lawyers but we have come to think that many folks would be better off hiring lawyers to manage their home improvement projects. They would at least get a valid contract upfront.
