Stacey of Wenatchee, WA (9/25/05): We refinanced our mortgage with Wilmington Finance. David, our loan officer, told me that he would be rebating the administrative fees to make their services more competitive with other lenders. When my husband and I went to sign the documents these fees were included and the fee schedules did not match up with other documents. I phoned David, while the notary was still in our home, to ask about these issues. He said to sign the paperwork and he would fix everything before the "right to cancel" time ran out. He told us "this is how it is done". He never fixed these problems, even though he told us he did. He said he would issue us a separate check (apart from our cash-out) and FedEx it. Again, he said, "This is how it is done". The right to cancel ran out without us knowing that the problem had not been fixed. He refused to return my emails and phone calls. I contacted his manager, Gary, who told me that he was now in charge of our refinance, not David. He also told us that he had no record or knowledge of such a conversation or email exchange and that the burden of proof was on us. We sent him a copy of two previous emails, but we were told that they were not enough to prove our case. He too will not respond to our emails or phone calls. We are out at least $650 in just the administrative fees. Damages: We seem to have no recourse. I really don't want other consumers to be lied to and scammed out of funds owed to them. Because of this issue we were unable to complete our home improvement projects. Report Your Experience
