I bought my home in December 2007. My mortgage with Taylor, Bean & Whitaker was $1601.12. The first year of my mortgage payments when smooth and I had no issues. The end of 2008 I began to get notices that I needed to provide proof of insurance within 30 days of TBW will charge me premium insurance and use my escrow to do so. I immediately sent proof of my internal policy on my condo and the external policy on the building but TBW continued to steal money out of my escrow each month. I made phone calls and sent them paperwork every month but they did not resolve this issue.

We did a short sale on our home. Sun Trust Bank gave the other people a loan and our house was closed on July 18,2009. Sun Trust Bank paid TBW the money they settled for on the short sale. We had a title company and the whole thing.
In around March 2010, Bank of America started sending us papers, telling us they were going to go through with the foreclosure and I kept sending this paperwork telling them the house had been sold in a short sale to avoid foreclosure. It even showed on my credit report that the loan had been satisfied and closed. Bank of America has still been sending me all kinds of paper on the place, telling me they are putting forced insurance on it and I again told them I don't own that house anymore.
Another paper came and gave an amount of insurance that they had put on the house. The deed on the house has been changed two different times since the sale and the amount of money that was to go to TBW was found and sent to BAC and a woman called me one day and said I have a check here for $82000. I said that's the check that everyone's been looking for. She says, "I can't put this towards your loan. You still owe us $90,000." I have been reverting back to the title company with the latter part of this paperwork. I told the title company, I've totally had it with this crap.
As far as the real estate company, the title company, my house was sold legally. I have recently gotten a paper from BAC'S attorney again, telling me that we are now being sued for the total amount of the loan. I have nowhere to turn to. I have the bill of sale, the HUD paper I was told to get by TBW to avoid any money left owed on the loan and was told by the HUD woman herself, that as long as that paper was along with the other paperwork that we would not owe any balance on that property.
That property was sold in good faith and we did nothing illegal. I think I have spoke to every employee that works at BAC. Faxes, copies and phone calls over the last year and a half is just too much. I got a letter from BAC's attorney that BAC paid $10 to take over all TBW's accounts as of Sept 24,2009. This was after my loan closed in July. I had not lived in the house since around Feb. 2009.
Bank of America has harassed me so much over this that I'm about ready for the nut house. I already have a heart stent from stress and now my husband and I have separated on top of everything after 20 years of being together. Seems like every week I was getting more and more paperwork from Bank of America, something on that house. I have spent so much time trying to explain what happened on that house. I am ready to scream. I think I should be able to sue them for harassment.
No one paid any attention to my phone calls or paperwork. I even filed a paper with the court house in town here when they said they were going to foreclose on it knowing that the older couple with health problems bought that house legally and I've kept most of my harassment from them. I need help with this and should have never been bothered once the first person got a copy of the bill of sale and even their attorneys got copies of it and they have still been harassing me also. I can't take any more of this crap. I never even received a paper saying that BAC took over TBW postmarked April 20,2010. How could I have known any of this yet they have harassed me to death?

They took the 987.64 that was supposed to be used to set up our escrow account and another 426.72 that was to pay county taxes that were never paid. Also, the check that they sent for school taxes in 2009 bounced and we had to pay 1214.90 out of our pocket when we sold the house in June 2010. This is a total of 2629.48 that they have stolen from us and we cannot get an answer from anybody. Cenlar jerked us around until the house was sold and then said, "sorry you no longer have a loan with us and call Freddie **".
Freddie ** said the bankruptcy has been released but I am not on the list to get any money from it and for me to email Taylor **. I did that but have not heard anything from them. I tried the attorney general, they told me to call the FBI. I called the FBI, she listened to part of my story and then sent me to someone's voice mail and I have not heard back from them. I am not sure who to turn to, to get help with this matter. I have all the paperwork showing the money they took out and what we had to pay at closing.

I was going for hardship refinance due to my spouse's death that strung me along about a modification for 4 months. I received the ball out and sold my mortgage to Ocwen Loan Servicing which is now foreclosing! They triple dipped! They are not only getting funds for my mortgage which was paid but then selling my mortgage again to Ocwen and now Ocwen will take my house! I'm just a widow facing being homeless with my children because of crooks and have no way of fighting them!

Bank filed bankruptcy and escrow funds and taxes were not paid. I have shortage in escrow account and taxes. As a result, it increased my mortgage payment.

I had gotten my first home loan with TBW in Oct.2008. I made my monthly payments on time. Then Sept. of 2009 I had gotten a letter from Band of America stating they have bought my mortgage from TBW and to start making my payments to them. So I sent my Oct. payment to Bank of America only to receive a letter from them telling me I haven't made a payment since July of 2009. I was like what are you talking about? They told me that not everything from TBW has been sent over to them but it was showing my last payment was June of 2009.But they would get it corrected. I had my wife gather all our payment stubs and all checks that had been cashed by TBW. We faxed Bank of America the info.
Next they told us that there was late charges and fee for July, Aug, and Sept. We have been battling this with Bank of America since they sent us that letter at the end of Sept. of 2009. Then we were told that they would just modify our loan for those back payments. But instead they kept telling us call back in 2 weeks and we will fax you the papers to sign to modify, well that 2 weeks never did come and still what we paid to TBW is still tied up with them going belly up.
And Bank of America I see as a Joke for the American people that are trying their best to keep their homes. Maybe some of you will be lucky. Hopefully none of you will end up like my family and soon to be homeless Due to TBW going belly up and Bank of America taking over. They never did a modify for us instead they foreclosed on us over the payments we did sent to TBW and all the fees and Bs that bank of America has pulled. Damage it has done to my family? TBW went belly up and everyone's money is tied up with them and Bank of America Wants all this money and late fees that's not even owed to them and they keep tacking the fees monthly where people can't afford it and then they Foreclosed on my family and as it stands we have like 35 more days before we are homeless!
Where the government is plans for to help us? I am guessing being spent on a war somewhere out of the US or building new home in some other country instead of help the America people here in the USA. Where will my family go? So thanks TBW and Bank of America for ripping our home out from us and making it where we will not be able to get another home loan.

To make an extremely long story short, we have had a mortgage with Taylor, Bean & Whitaker for a couple of years. Last summer we decided to do a streamline, still using TBW. In Oct. or Nov. 2009 we received correspondence from Bank of America saying that they had taken over our loan, however, they had our old loan (prior to the refinance in July 2009) information. Eventually we were made aware that TB&W had filed for bankruptcy, however, TB&;W contacted us and told us that our loan was still in effect and to continue making payments to them, which we have been doing. We have even received monthly statements from them and have been able to visit their website, etc.
Last week, we received a "notice of cancellation" from our homeowners insurance company because our insurance had not been paid!! Then we tried to refinance this week (Aug. 10, 2010) to get away from TB&W, and found out from the company helping us that TB&W has not insured our FHA loan and so therefore, we cannot refinance! I have tried to call every phone number that I can find, only to find that they all have been disconnected. I have searched on the internet only to get messages that the websites don't exist.
I have tried emailing to 2 different emails where we used to get correspondence only to get the message that those are "invalid" addresses. We know that they have cashed our July payment because it went through a couple of weeks ago. So they are cashing our payments, but they are not keeping their legal end of the contract to pay the homeowners insurance and/or insure the loan itself. I am frustrated beyond belief and can't believe that there is no way to get in touch with this company at all.

The problems all start one day. Out of the blue, I came home and got my statement out of the mail. It said I my payment was $1900, I said well that's wrong. My payment is $1502 a month and I know I have a 30 year fixed mortgage. So I then call Taylor Bean to ask what's going on. I was on hold for about an hour.
Then they told someone would call me back in a few days. They needed to look into my account, days went by no call. I then called them again and then said I owed back property taxes. I asked how if my taxes are in my mortgage and my payments are up to date how can you just raise my payments like that. I explain that I was on workers comp and could not pay that amount. So I asked can they put the payments in the back. They said no. the will make it $1700 and if I didn't pay they would foreclose.
They miscalculated my taxes and in the end I paid the price. I sent letters from my doctor and my son's doctor. My son has no arms and many other medical problems. They didn't care. They were cold and rude. They would hang up on me after having me hold for hours. They foreclose on me. I would say 3 days after that they had someone break in my home and change my locks, destroy my house and my belonging. I couldn't believe it, the garage doors were locked. Also, I happen to run into the man on his way out and said I was calling the cops. He then gave me the keys and said they told his company that I left the property sure with all my clothes, furniture and food in it. I think they were call 5 brothers.
The next day the same man called and said I had to have my things out. I was told by a friend of mine who was a couple that's illegal. He winterized my house so I couldn't stay there and all my stuff was everywhere. Anyway well I did call the cops. The officer walked in after running my address to see if a judge ordered me of the property and nothing came up in his computer/ he walked in and said they really well you need a lawyer. I search and everyone wanted money to take the case. Then I met this lawyer who tried to help. Then it turned out that he couldn't help me. I just want to know how things like this can happen to people.
That was Nov 2008. I was kicked out without being served a dispossessory notice then they filed one after my police report. I am just getting my life back together. I've been in shelters. At one point in my CA. I've sold my jewels for next to nothing to get a place to stay. Finally, God has made way for my family to get back up again. We just got a two bedroom apt, family of 5. It's not much but it's better than that one room we were in for a year with rats and roaches. From my dream, I found a room for us to live in that caught on fire Feb. 2009. Then we were back on the street going into a shelter. It was so nasty in some of those places. I didn't even want to touch anything, bed bugs.
My kids had bites on them and viruses. We were always sick. I hope that this never happens to another family. I'm happy they are closed. I made that the government allowed these to happen and then step in. They shouldn't give people there homes back with no mortgage after the hell the put them through. Good Luck to all who have been in my shoes. If Taylor Bean didn't try to scam me out my mortgage all of this would've never happen. My boys would've still been playing in their backyard with their friends. I only wanted my home back.

My wife and I refinanced our house with Taylor, Bean & Whitaker Mortgage Corp. It was later that we learned that they sold or transferred our mortgage loan with Bank of America. We learned this from Bank of America. We were not notified that this had taken place. We had already paid two months into the loan. We also later learned that the company was closed down due to unlawful business practices. We're really not sure how this has impacted us, but it is my understanding that one bank cannot transfer a loan to another bank when there are violations and clearly, there were. I feel we could have been given a better rate or at least, been able to negotiate a better rate on our loan.

My home loan was with them and in the middle of august the sold the loan to bank of America and now I am getting 10 calls a day from bank of America stating I miss my August payment explain to them that I pay my payment to Taylor and bean and they need to get the money from them, they have that on their system and bank of america keeps calling every day at least 10 times to see when I am going to get my payments caught up. I am getting tired of the phone calls and they interest is adding up every day since they think I am behind. All I ask is please start calling Taylor and bean and bug them for the money instead of me.

My mortgage had been with TB&W for over two years. I made the August and September payments to them, not knowing they had been closed down. I tried to refinance my mortgage and was told at that time what happened with TB&W and that my mortgage was now with Bank of America. I received nothing from Bank of America about it. They called one night and asked where my payments were. I told them I had sent them to TB&W. They stated that they had sent me a welcome packet. I never received it. About a month later I finally was given, over the phone, my account number and address to sent my payments to.
Since Bank of America took over my mortgage it has gone up by close to $200. In January I received a letter from our insurance company that the insurance was due. I knew it was suppose to be paid through my mortgage so I didn't think anything of it until I got a letter saying they were canceling my insurance for non-payment. I had this insurance company since I bought my home in 2006. My husband contacted both Bank of America and our insurance company and gave them all the updated information at least twice.
When I received the final cancellation notice from the insurance company I called both Bank of America and the insurance company. Both stated that neither had spoken to my husband, even though he had all the information written down. The insurance company refused to reinstate my insurance coverage. All the insurance information was in the paperwork that Bank of America has. Bank of America then added their own insurance policy, which the premium was triple what I was paying to begin with. That, of course, raised my mortgage payment again.
Now we are facing foreclosure. My husband is disabled and I still work full time but our income has been greatly reduced with medical bills increasing. I contacted Bank of America several times for help. They refuse to help us. I also tried to refinance again but they wouldn't approve it because the last couple of payments I made to TB&W still have not shown on our credit reports. We are now working with a non-profit (they do not receive help from the government for what they do) mediation group.
I am not holding any hope from them because Bank of America has been very difficult to work with (as I have been told by several people in position to know!) From what I understand, Bank of America is making more money by forcing foreclosure on families and then reselling the homes. They are not using the Federal funding the way it was intended to be used, to help keep families in their homes.

Since dealing with Taylor Bean Whitaker, I have been passed to 2 other companies and have been dissatisfied and treated terribly because of this frozen payment. I have proof from my bank that my last payment to TBW cleared on 08/11/2009 for $1435.81.This money has not been applied to my mortgage and is now is affecting my credit rating and I need to get it back!
I understand that Taylor Bean Whitaker received my payment and processed it on 08/11/09, but it has not been applied to my mortgage yet due to the bankruptcy proceedings. I need to find out how I am ever going to get my frozen payment back. I need to know what the status is and if there is anything I need to do to get my money back. This process work and how will payment be linked back to me and my mortgage? The mortgage number has changed every time! Please help me out! Any direction will be greatly appreciated.
This has caused emotional and financial damage. I have been receiving daily calls, certified letters, etc. from Ocwen treating me like a criminal because of this missing payment. I have sent proof of the check 4 times to them and explained the situation, and they keep on harrassing me. I need my money back from TBW, so I can gain back my finances and my sanity!

I had my home loan with Taylor Bean and Whitaker for two years. Last August my loan was sold to Bank of America and I was not informed. In August I made my house payment to T.B.W. just as I had for the years prior. In September I was contacted by Bank of America and notified that I was now a month behind on my house payment, and they had received my escrow in a negative balance but my insurance had not yet been paid. I informed them I had made the payment to T.B.W. and was told not to worry just to fax them proof the payment was made and in a couple months it would be created.
I have in the last eight months faxed thirteen times the proof that the payment was made and cleared the bank. The first twelve times I sent the fax to different numbers given to me by service reps. The last time I called and asked to speak to a supervisor he said those were not even B.A.C. fax numbers and he had no idea where I had been faxing my information but did give me the correct number. After that I was then informed that did not matter. It would not be created until B.A.C. received the funds.
My house payments have gone up to cover the negative escrow balance. I'm now having late fees tacked on every month for the August payment not yet received, and they are now reporting negatively on my credit report for the late August payment. I still have not had anyone explain what happened to the money that should have been in my escrow account for my taxes and insurance. I have been fighting with B.A.C. to find out what I can do and keep being informed there is nothing I can do. I have cried, screamed, cursed, and begged, and gotten nowhere. Is there anything I can do?

We went to closing on 12-4-07 with TBW loan. Payments were withdrawn from my checking biweekly we made three and half payments. I received a phone call at work telling me we no longer had a loan. This was in April 2008.

As most know, TB&W filled a BK last Aug. All of their accounts were divided up among four other companies. Mine went to American Home Mortgage. I did not find out until Dec '09 who was actually handling my account. I was not informed as to who I was transferred to. I had to search and find the company. According to AHM, they took over in Oct '09. My taxes were due Sept 1, 2009. My escrow account which contained money for both my taxes and annual insurance about $5000 was frozen as part of TB&W's assets. My taxes were not paid and became delinquent and were sold at auction in Nov '09. AHM paid the delinquent taxes, my insurance and fees and penalties.
They then turned around and charged me a short fall in my escrow account for the money they paid out while the money I paid to TB&W is sitting there (I hope). With TB&W, I had until the 15th of the month to make my payment which worked out fine since it takes two pay checks to get enough money together for my mortgage payment. AHM only allows to the 10th, five days short of my second payday and charges me an additional $85 a month even though it states in my contract I have until the 15th. If I don't pay the late fee, they deduct it from my mortgage payment making it short and reporting it to the credit reporting companies. In the last three years, I have had annual pay-cuts. I used to have a cushion at the end of the month. With these increased charges and held money, I usually end up short at the end of the month.

We had TBW for 2 years. I never got a real person, rather only generic letters that did not answer our questions. In August 2009, we sent in our payment as usual. Shortly afterwards, Company B comes after our hide for not paying, wanting 3 months, yeah, in my hip pocket, not! We have TBW not Company B! ** began! TBW had no contact, totally evaporated! Company B is still wanting our money, house, etc. We were told we have bad credit, they will take the house, etc. Company B just wanted the money they were due, we wanted our money due from company A! No one could give us an answer. Company B just wanted all of our information! We're not dumb! Company B finally told us 4 weeks later that TBW pulled out and folded. When the money got to Company B after being frozen, we got some answers, but not much. Now how do I get a real live person at TBW to get out my tax info for 2009?

My account was transferred from TB&W in August. I was on the Equity Accelerator plan and made a partial payment to TB&W on August 21, 2009, which was to be applied to my September 1, 2009 payment, since my account was sold my partial payment wasn't posted to B of A and now they are claiming that I am behind in my payments to them. I spoke with the representative at B of A and they were aware of the issue with TB&W and I have sent over bank statements, statements from TB&W and from Equity Accelerator showing that the payment posted and was received.
But they are still claiming that I'm behind, which means that I can't refinance with a new lender to get a better rate and every month, I get phone calls and statements about not making my payments on time, which is bordering on harassment and I have never been late. I even got a check for $947 from Equity Accelerator back in December because I had to pay them an extra mortgage payment to be set up with them.

On 1/29/2010, I called Cenlar to make sure they applied the additional escrow shortage that I sent (and clearly marked) on the payment coupon they sent me. First, I was reproached for not sending the entire escrow shortage amount of almost $400.00 all at once! I sent 2/3 of the amount and planned to include the final 1/3 in next month's mortgage payment.
Next, I was told that the mortgage payment that I sent was $50.00 short. I explained that the amount I sent (minus the escrow shortage payment) was the exact amount written on Cenlar's payment book that they sent me. I was then told that the amount was wrong. I explained that that amount came from them and I would gladly sent them copies of the remaining payment coupons. Cenlar said it did not matter what their payment book said, my new payment was now $50.00 more?
They never were able or willing to answer my original question, "whether or not they applied my additional escrow payment correctly?" nor were they able to justify why the payment book (with my monthly amount due in writing that Cenlar sent me) was incorrect and why my monthly payment has gone up $50.00. I am a former Taylor Bean & Whitaker customer and Cenlar was dumped upon me. Do we, homeowners, have any recourse? I have no idea how almost $300.00 of additional escrow was applied. I have no idea what my true monthly mortgage payment is.

I had the mortgage on my house with Taylor Bean. I was never informed that the company was shutting down and that Bank of America will be servicing the loan. There is a huge discrepancy on the balance on my loan. I owe almost $4000 more than when TB was my financier and my mortgage payments have increased by $80 each month with no explanation. To add insult to injury, I received a letter that there is no insurance on the house and that I needed to buy insurance although part of my mortgage payment include escrow.
Unfortunately, I had trashed my last mortgage records from TB. Bank of America officers at my local branch cannot provide me with details of how much my loan balance was and when it was transferred. I am being robbed blind in broad daylight and look on helpless. My mortgage has been reported late and damaged my credit report.

I had sent in my August payment to Taylor Bean and two days later I found out they filed bankruptcy. Still to this day (1/27/2010) they have not received my payment for August! I refinanced my mortgage in October, I received some money back from my Ecsrow account but the government is still holding my August payment from me. I have contacted BOA so many times about my issue and no one is willing to help me. I am very frustrated with the situation, the government has no right to be holding the money that they owe to their customers!

On April 13, 2009, my home was severely damaged by a storm. The damage caused my family and I to move out completely. During this time, my insurance company sent a check payable to me and TB&W. I was told that due to the amount of damage and claim to protect the mortgage company, I had to endorse the check and send the check to TB&W. They would then return disbursements in thirds back to me until the project was completed. So the process began, I sent the check in May. I did not get the first disbursement until June. My contractor had begun the work on my home prior he or I receiving any funds (I thank God for him). Work was progressing on my home. A month or so later, I received another draw.
The contractor did not immediately deposit the check which I'm sure he did not foresee any problems by depositing the check later. However, the check bounced. This is when I discovered that BOA had assumed my mortgage when I could not get in touch with TB&W. So now, I am dealing with partially being in my home and paying the mortgage to BOA while BOA keep telling me they have contacted TB&W but no response has been received from them.
The check that bounced from TB&W was $20,859. I don't know what to do because I keep coming to a dead end when I contact BOA and you know I can't contact TB&W anymore. So I have decided to send letters to Barbara Desoer, BOA President of Home Loans and Insurance, Attorney General Bill McCollum in the State of Florida, as well as my congressman and senator in the State of Alabama. I hope I get some results soon.

How can I receive a 1099 from TBW? Two payments payment checks were received but not posted in July before my loan was transferred to Ocwen. How can I get late charges off my account and credit report corrected? Ocwen has corrected the payments but numerous calls to Ocwen have not corrected the late charges and credit report.

I too had a mortgage loan with TBW. I sent in my August 1, 2009 payment, which was cashed through Colonial Bank in Orlando, FL on August 5, 2009 and cleared my bank on August 7, 2009. On August 21, 2009, I was notified by BAC that they have taken over my loan and that TBW should not deposit any checks after August 5.
I have since been receiving late notices from BAC each month stating that I need to make my August payment, which I have made through TBW. BAC finally admitted that TBW had gone through bankruptcy and the funds were frozen. In the meantime, I have provided proof that my check was cashed through TBW on said date.
I am again attempting to fax (which never works) a copy of my bank statement and again another copy of my check to show that I made my mortgage payment. Each month, it is the same. I am concerned that my taxes and homeowners insurance will be messed up. I used to be able to go through the drive-thru and make my payment with BAC. However, now, BAC won't accept my payment through the branch banks, because BAC is starting to incur late fees on my account! I am not late! This is the company that was bailed out by our government! Where is the justice? Large corporations should not be able to hold consumers hostage when I can show legal proof my money was paid/cashed/and obviously misappropriated by CEOs.

Sent in my August 2009 payment, was cashed on 8/10/09. Received a letter from B of A saying as of 8/5/09 that I was no longer to send payments to T,B, and W. Ever since then B of A has accused my of being late, or one payment behind. I called for the first 4 months to make sure everything was going okay during the transition.
I receive 10 phone calls from them a week and when I call them back they ask me what they can do for me. B of A assured me that no late fees would be assessed to my account, however, my December 2009 and January 2010 payments have had late penalties added to them. I am afraid that my credit as well as my home is in jeopardy everyday. I am worried that the neglect of others is going to have negative effects towards me that will take years to correct. I am also tired of getting harassed by B of A.

My mortgage was with Taylor Bean Whitaker Mortgage. About two years since August 2009, I have been waiting for my escrow money! Who is going to help us all out there who have been waiting!

We have a mortgage with Taylor Bean & Whitaker on our present home. The federal government shut them down in August 2009. We were finally contacted by an unknown company referred to as CENLAR FSB Loan Administration that they were servicing the loan as of September 2009. I presumed you aware of all the above; however, I am desperately trying to make this e mail simple.
We purchased and closed this newly constructed home April 2005. We then finished and made improvements to house and lots bringing up the value. We requested that the mortgage insurance be waived per the re-evaluation of the home. We were granted this waiver from TB&W in April 2006. (See attached) When we could finally get online with CENLAR (we could never get anyone on the telephone), I informed them of this fact so that they would correct our records. I have sent them proof of the waiver twice. I sent them the "qualified written request" on September 2, 2009. (See attached) We have never received an answer!
We are trying to re-finance and apparently, CENLAR FSB is demanding us to pay them $3000+ in addition to a payoff for back PMI. (See attached) This is outrageous! We again faxed proof to them last week. Today, January 19, 2010, we received an email telling us that we must send a signed letter requesting they honor this waiver. We have repeatedly made several "qualified written requests" per the law. (See attached) Note, we have yet to talk to a real person other than a person who answered general questions and would not give me a person to talk to in their PMI department.
Can you help us get this resolved or do we have to hire an attorney? We do not have the money to hire an attorney and we should have to do that. CENLAR is trying to collect money for something that is not owed and they have not sent us written response to our original request. I also asked for verification of my payments to CENLAR and they will not send them to me. I do have my payment verification to TB&W through August 2009. Thank you for your kind consideration of this matter.
The address given above is where payment are sent. After digging, I found their Corporate office in Trenton (Ewing) New Jersey. They are crooks. I have sent letters to HUD and the US Attorney General's office. Prevented us from refinancing at a better rate and now we are stuck with them.

I refinanced my house through Taylor Bean & Whitaker. They sold my loan to Wells Fargo a few months later and forwarded all of my payments, but one which keeps me a month behind constantly. I have contacted them time and time again each time getting the old "checks in the mail" story. They still have not paid it. It went from a 700 credit score to mid 500's.

I too am a victim of Taylor Bean and Cenlar. Taylor Bean withheld escrow two times. Once just months after my mortgage started and then a year later. I had special papers drawn up to release any escrow required because I didn't want to get caught in the exact place I am in. I have a credit score of 810 so there was no problem. The first escrow attempt was dealt with in a totally unprofessional manner and took numerous phone calls and hours of my time to right. The second has yet to be settled and Taylor Bean kept putting me off because they knew they were going to sell to Cenlar. It is as far as I know illegal to change a binding contract which is what they are doing.
As you all know, Cenlar is all but impossible to reach and when one does, they are treated with total disrespect put off repeatedly which is of course their plan as to aggravate you to the point of just giving up. Well, aren't they practicing illegal act of outright ripoff and should be dealt with by our government? Call your representative or congressman/woman and make a complaint. Do so many times as to get their attention. Call the Better Business Bureau and do the same. If enough of us do, we will be rewarded with at least some sort of legal action. Until then, maybe we should all start putting our mortgages into escrow accounts. I bet that would get their attention. A hit in the pocket will get their attention just as it has gotten ours!

Same as with the other complaints I have read about. My husband and I had our home loan through TBW. Our account was turned over to Bank of America without our consent. However, TBW failed to send Bank of America our escrow, and as a result, our payment has increased by about $400.00/month until we have enough in escrow to cover taxes and insurance.
The increased payment has put a financial strain on us. Fortunately, we have been able to make our payments on time. However, we want TBW to give us the money we had in our escrow account. If I go into a bank and rob it, law dictates that I go to jail, pay fines, etc. What recourse do I have as a consumer who has been robbed by a large corporation?

I had a home loan with Taylor Bean & Whitaker. It is now in the hands of Bank of America, not by choice. I, too, am missing a payment made in August, which was my Sept. loan payment. This payment includes my FHA MIP, Homeowners Insurance and property taxes for the 2009 tax year. At the end of August, I received a letter from Bank of America, Notice Date: August 23, 2009. This letter stated that as of August 05 2009 that TB&W would stop accepting payments and as of August 6, 2009, Bank of America will start accepting payments. (I kept this letter. Thank God.)
Well, they tell me this at the end of the month and I had already sent my payment to TB&W on August 7, 2009. Now, this money is gone. I have even sent copies of the front and back of the check as proof that it was paid and this is what Bank of America wanted. I also sent it to TB&W. I have faxed this 3 times to BoA and now they want my bank statements for the months in question since I pay a month ahead.
At this new request, I was very upset. My banking is not their business, if I wanted it to be, I would bank with them. I do believe the cashed checks are proof enough. As if all this was not bad enough, tax time came and out of my escrow Bank of America paid my property taxes but they also paid someone else's property taxes out of my Escrow account. Now, my escrow account is short even more and I do not have enough in it to pay my homeowners ins. I have talked to a lawyer, in fear I may have my house foreclosed on and he is very interested. This could turn into a class action suit so take that site down, it may be the help we all need.

Taylor Bean Whitaker has closed and I was informed. However, I paid the mortgage payments to them but was never posted to my loan and now, I have to do a loan modification because of this. However, we still don't know where our money is.

Our mortgage was assumed by Cenlar from TB&W. Cenlar started adding homeowner's insurance to our monthly payment. When we called to dispute this and explained that the insurance was something that we paid on our own, they asked us to fax over proof of our insurance. I did this the very next day and it was not corrected. The next month they asked me to fax it again; this time I faxed it as well as my insurance company. It's still not fixed. This has been a monthly problem with no resolution in sight.
I call every month to take care of it; however, this error has increased my monthly mortgage payment by $500 per month of which I do not have any additional funds to pay them for their errors. In addition, I have had to mail my mortgage payment monthly in the amount that I am supposed to pay based on my original mortgage. This has caused 2 issues. I am unable to pay my mortgage online because the payment amount is not correct. In addition when I mail my payment they wait 3-4 weeks to process it and this will have an negative effect on my credit which I have worked very hard to keep in good standing.

TB&W was or mortgage company until August 2009. We were not informed that they were in trouble I made my August payment on line and now it is showing up as a missed payment. We were working with them on a loan modification we received the papers & everything, that never happened. The bank that has our account does not do re-finances or modifications.
We are really upset and feel like we have been cheated. Why weren't we notified that they were going bankrupt? Now we cannot do a loan modification, it just doesn't seem fair. I was reading other peoples complaints about TB & W, and I could not believe how much we all have in common! What did TB&W do with our money?
We had applied to TB&W for a loan modification received the papers by Express Mail never heard anything else from them... We've missed out on that opportunity, which we really needed. They show us missing 2 payments, that's not true, yet that's showing up on my Credit Report. They show us having $489.00 in late payments.

Noone will tell me what forms I need to fill out or anything. I really need that money as now I had to add to my monthly payments to make up for the loss. I am struggling to make it.

CENLAR assumed responsibility for handling home mortgages once held by Taylor, Bean and Whittaker. I redirected my monthly mortgage payments to CENLAR without incident--UNTIL-- I received my property tax statement from the county. The new rates had dropped substantially from the rates previously calculated by Taylor, Bean in 2006. I notified CENLAR informally via phone and was told to fax it their "tax department." Therein began my frustrating odyssey with the CENLAR staff.
Other than the fax confirmation, I never received an answer to my cover letter which asked for a review of property tax assessment. I called at least 5 times and was put on hold or told to call back because the lines were busy or recorded words to that effect. When I did get a CENLAR rep on the phone, I requested that they respond to my request for a property tax review. Again no response from CENLAR.
My next attempt was to write a formal letter to CENLAR which I sent via certified US Postal Mail. Again no response from CENLAR.
At this point, I felt as though CENLAR was purposely avoiding my communication efforts. Shortly after this I received a new property tax assessment from CENLAR and was horrified to find that they had "increased" I then attempted to contact them again via phone despite inordinately long wait times and customer service reps that provided canned responses gleaned from a manual.
It was at this time that I discovered my calls were being routed to INDIA vice the US so during my last call to Matthew in India I asked to speak to a US supervisor. A few days later, I received a call from Tiera Mason who was unsympathetic to my verbal complaints and offered very little in the way of corrective action.
I am on a budget and unplanned increases will affect my ability to pay bills.I hope my experience will in some way cause CENLAR to reexamine their "customer service" approach with the overall objective of addressing customer in a timely, professional and respectful manner.

I was blindsided by TBW. I was using an equity accelerator company and my mortgage payments had been on time for years. By the time I discovered TBW was in troubled and that the accelerator company had stopped taking payments in August, I was three months in arrears. After I finally found my mortgage, I am working with the servicing agency to catch up. I am in the process of making my last payment to catch up but have been dealing with representatives from outside of the United States who have not been nice and trying to force me to borrow money from family and friends to catch my mortgage up right away
In addition to all of the paperwork, talking to numerous representatives, the latest is I found my real estate tax payments had not been sent from my escrow account. I had to fax a copy of the delinquent tax papers with penalty and interests that I received in the mail. After faxing those papers to the servicing agent, they claim the tax payment was mailed on 12/18. I am so tired of all of this. It shouldn't have happened. I was doing the right thing and paying my account every two weeks automatically. I received no notice from TBW or the accelerator company until I made contact with the accelerator company to question why monies were not being taken out for my mortgage. If I had not reviewed my account and contacted them, I could have been in foreclosure with no knowledge I was headed in that direction. There should be a law against this. This has been very inconvenient and a painful process, and I am not sure what the next few months have in store as this is only a servicing agency that I am currently working with. It is just not right.

I sent my payment to taylor bean in aug they recieved it aug 8th then my loan was sold to bank of america home loans they never sent the aug payment to bank of america now bank of america has been on my case saying I am behind which I have never been late since I bought my home I even recieved a foreclosure letter this is crazy every month I am on the phone trying to sort this out and they just keep telling not to worry but i find that hard to swallow and especailly since the letter I recived about foreclosure not to mention the the harrasing collection calls I dont know what to do at this point I have recipets for every payment I made to them

I have had to call the past two months in order for them to deduct my payment manually. I am totally aware of the situation they are in, but have been pretty satisfied with my issues even though they are somewhat slow on their response time. I know I need to be patient and wait for the TBW issues to clear the air.

Taylor, Bean and Whitiker's insurance department claimed that I never sent proof of insurance covering our condo association. I immedeatly went on line and ordered on to be sent by fax to TB&W. I recieved a confirmation from the insurance agency that they did, indeed, fax a copy. I received another letter from TB&W threatening to buy insurance and charge my escrow account if I did not send a copy of the condo's insurance policy. I called and they assurred me it was taken care of. I requested another just to be safe. Sure enough, when the escrow account statement was issued in early summer, they charged me $3000 for insurance! I was outraged and wrote to the attorney general. The case is still pending. In the meanwhile, Taylor, Bean & Whitaker has declared bankruptcy and assigned CENLAR to service their loans. Please check and make certain that you were not charged!!!!!

I'm not sure how they come up with their various calculations, but since September when they took over our mortgage, our payment has jumped nearly $300 a month! Articles about the closing of TB&W said that the transitions for TB&W customers would be "seamless;" they have been anything but. When we call any of the three toll free numbers listed by CENLAR, we are on hold for at least 1/2 hour each time. This is ridiculous! Threats of cancelled home owner's insurance; $300/month increase in mortgage payment.

I have been told that my payment made on Aug 10th was supposed to be at B of A by the end of Nov. I am being told by B of A that it is not there fault and they cannot do anything to help me. They are working with me and waiting for the money to be transfered. I spoke with my bank that sent the payment and they cannot retrieve it. It seems like I'm getting the raw end of the deal for making my house payment.

Our escrow check bounced, when they tried to deposit into my bank. I called our former loan officer and found out that they had gone into bankruptcy. They never sent us a letter or anything. Fortunately, she had a lead on where to go to get our escrow money back and I wanted to share that info since it is not readily available from TB&W. I got lucky. She was a good officer, even though her company [was bad]....There are two more hearings listed on the docket for Dec 2, and Dec 15th. if you wait too long to file a claim, I don't know what will happen.

I was a customer of Taylor Bean & Whitaker Mortgage Company. My taxes and insurance were escrowed thru my payments, and i received a late tax notice this past winter about January 2008, the notice came from the county treasures office where i live. the bill said that they have not received my tax payment for the year 2008. I over looked it thinking this was a mistake, until i received another late notice.
I was unable to contact any one by phone at taylor, bean & whitaker. I faxed them a copy of the tax bill in May 2008, i've had no response from them regarding this matter. In late August or September i received a notice saying that my loan with tayor, bean & whitaker was being sold or transfered, and that i would get a notice from the the new servicer, (Ocwen) in a few days. I want to know where my money is and how do i go about getting it back.
I have since received notice from the new servicer, Ocwen LLC. i have faxed them my tax notices and they have paid them but they are holding me responsible for repayment to them and has since raised my motgage payments to recover the tax payment they paid for my account. Taylor, Bean and Whitaker why should i have to pay my taxes twice, and in the process incurr additional hardship for me and my family thru added funds on my payments.
The stress and hardship financially of having to pay taxes twice. unable to catch up my mortgage. The calls of over due payments. the threat of loosing my property for unpaid taxes. the embarrasement of having my name published in the news paper for unpaid taxes, if i don't continue making the added amount to my payments to Ocwen LLC., because they would request their money back from the county where i live.

I had my mortgage with TB&W for two years when I received a letter from Cenlar stating they are my new mortgage company. I did not have any problems with my payments being late, I didn't know of the problems with TB&W. In October 2009, I received my Annual Escrow Account Statement. It stated that my escrow account was short and therefore my mortgage was going up almost $600 a month. After several calls to Cenlar and one to TB&W found out that in December 2008 TB&W took out $3,214.00 to pay hazzard insurance. They paid this money to Proctor Financial Group for insurance until April 2012.
The problem? I pay my own homeowners insurance have since I bought my home. Whe I called TB&W and explained this, Sarena told me to fax her proof of insurance and they would reimburst the money to me. That's when I found out about TB&W being in bankruptcy. I explained this to Cenlar, sent them proof of insurance also. They sent me a letter stating I owe them the money. TB&W stole money from me and yet I still expected to pay Cenlar the additional money. HELP!

I had a mortgage with Taylor Bean and Whitaker and I refinanced with Wells Fargo. I had $1200 in escrow at Taylor Bean and Whitaker and they mailed me a check for the amount. I deposited the check into my checking account and it was returned for non sufficient funds. Apparently, Taylor Bean filed bankruptcy and all of their assets were frozen by FDIC. This happened in August of 2009 and I still haven't received another check. They still owe me over $1200. Will I ever get my money?

It has been a complete nightmare! I was never told that my mortgage was sold becasue of TB&W closing. i tried to get ahold of TB&W but of course like other people said, either the lines were disconnected or you were only hold for HOURS! So i then tried to start working B of A and they dont know what the heck they are doing. I have called six different times to B of A and got the run arround every single time! My escrow account didnt get transfer to B of A so they were trying to up my payment by $300 PER MONTH to make up for the "shortfall" i would be having on my escrow to pay taxes and insurance, keep in mind my taxes are going down! So then I find out that TB&W send my insuace and tax oompany a check but they bounced! So now I am getting bills to pay them when I have already paid them and B of A is trying to charge me instead of trying to ge the money from TB&W. It has been a huge nightmare and the only way out that i can seem to find is to refi with a new bank. I have called B of A 6 times and each time I get a different story as to what my payment is going to be and the reason why! It is so freaking frusterating! I have been trying to see if aynone knows if there is a class action lawsuit for the people that have been getting kicked around because TB&W didnt pay the bills.

I had an excelerated mortgage with TBW for over 1 1/2 years. The excellerated mortgage was automatically taken from my checkin account twice a month. I was never late on my mortgage and I has a good credit rating. The company TBW used for their excellerated program had taken the August and September payments out of my bank account. I received a call from Bof A the day befor I even knew they were to be my new mortgage company. they continued to call me everyday at work and hassel me that I was behind on my mortgage. I have tried to talk to them many times tell tll them I am not behind. My mortgage payment was mad on time and they need to find out what happened to it since I did not elect to have B of A. They should contact the governement and straiten it out. They insist I am still 2 months behind on my payments. This entire situation has ruined my credit. What can I do about all this?

I was issued a check for $2476.20 for an escrow surplus right when the government shut down this company. The check bounced, and I have never received my money. My loan was transferred to another company, but only after my check was issued. I would like to get the money I am owed. Every month I call TB&W and they tell me the same thing; the bankruptcy court has not yet released the funds. It has been 3.5 months and I do not know if they are lying or if I will eventually receive my money.

My husband and I both have physical problems that get worse when put under stress - we have explained this to BAC but they do not listen nor care.

Do we not have any say so in who owns/buys my mortgage? I am not happy.

My husband and I used TB&W's equity accelerator program and even though they had sold our loan to Citi Mortgage we continued to make our payments this way. It was convenient and we never had any problems until our Sept. payment was frozen in their accounts and not forwarded on to Citi Mortgage.
Through several phone calls to TB&W and Citi Mortgage I was told that I had to remake my Sept. payment(even though I already had) or I would be considered late. I have NEVER HAD A LATE PAYMENT on anything! So we made our payment again, then a week later we received a letter from Citi Mortgage stating that we did not need to make that payment and that they understood that it had been made and was frozen in TB&W's accounts.
So I called and said so if I didn't need to make that payment again does that mean that we are paid ahead a month? No my India customer service rep said you have to make all payments every month and we didn't send you any letter. ARGH!
So I call the equity accelerator program every day to see if my money has been released yet and every day for the past month it has been "no but it will be soon". (Whatever!) The way this was handled by everyone was (or should I say was not handled) is ridiculous! Everyone that had dealings with this company should have been notified and the funds that did NOT belong to TB&W dispersed.

I purchased my home in January of 2005. It was a manufacured home I put on some land on good foundation. It is a modest home but mine and I was thrilled to have it. My original loan was through Banner Bank and was on an ARM which I needed to get out of after 3 years. In that time my monthly payments were made by electronic transfer on the 10th of each month. They were never late, and never missed.
My bank would not refinance my loan for me, kept telling me it was not in my interest, but could not tell me where the payments would be going over the next few years. That did not seem in my best interest so I refinanced with Discovery Mortgage Comany who then sold my loan to TBW. These people were the all-time worst. All of the accounts I have read are true.
First, I did not know my account had been sold until I began getting foreclosure notices from TBW. After 3 hours on hold I finally got a person and commenced several days and numerous hours on hold trying to find out why my payments were late when they were on electronic transfers. Finally, my bank informed me that TBW was rejecting the transfers which they would attempt a few times before snail-mailing the payment to TBW and at that point the payment would be late. Of course, TBW denied all of this causing more hours of telephone calls.
Finally, one of there people admitted that it was indeed the fault of TBW for not accepting the electronic transfers. I do not even know how many $200 late fees I was charged by that time. They wanted me to allow them access to my bank account to pull the money out themselves. Fortunately I refused this dasterdly request and I began sending my payments by snail mail myself and later had to start sending it by certified mail becuase they would receive the payment process it, clear my account and they would still leave recorded messages saying they had not received it and charge me late fees.
Unfortunately, by this time another problem was in the making. They had sent me an escrow refund shortly after taking over my loan. I had no idea that it was not truly a refund. This is the only house I have ever purchased, and have never planned to leave this home, and I had no idea what was about to hit me. Later I began receiving calls and letters about my insurance coverage.
I had to contact they insurance companies involved to make sure they knew who was to be receiving payments. I also spent more time the TBW on the phone, however, TBW paid BOTH insurance companies. In the end TBW DRAINED my escrow account. I spoke with a Becky who assured me this would be cleared up and an escrow account audit would be done and I would received the report - never happened. I called her direct line and sent emails all to no avail.
I contacted a lawyer who sent them a letter, which never received a reply because unbeknownst to me they were being investigated and effectively shut down by the federal government - no surprise why. One of my payments still has not cleared my bank and was delivered to the appropriate TBW address long ago. My payments have now increased from 1165 to 1400. While all this was happening I hit a health crises and my husband lost his job due to economic problems. We continue to have health issues, are looking at additional decrease of income and now I have no idea how to refinance and who to turn to. I have worked very hard to make sure every payment was made but feel I am now penalized for being a homeowner.
I do not want to lose my home. I am very angry with the banking industry in general and TBW specifially for the predatory practices on good people just trying to provide a home for their families and getting totally ransacked by greedy, thoughtless, moral degenerates who spend more on vacations than I see in my entire year's wages. These people should be ashamed and those who supported laws to allow this to happen should be as well.
My escrow was drained approximately $3000, untold late fees I estimate could be around $1000, and increase in monthly payments up to at $300 to $400 per month. I endured immense stress during a time I was having very difficult health issues and my payments have increased from 1165 to 1400 or 1500- I am not sure what Banc of America is going to do at this point.

I received a letter from TBW on Aug 21,2009 after I already made my August mortgage payment. They said my 2nd mortgage had been sold, but my 1st mortgage was still with TBW. My August payment didnt clear my bank until the end of September. Meanwhile I received a statment from TBW to send my September payment to a different address, which I did and it did not cash until the the beginning of October. They are still sending me statements. Everything is OK with my 2nd mortgage. I know who bought the loan and who to make my payments to.
My mortgage payment included property taxes and homeowner insurance. My insurance company called me and told my Homeowner insurance had lapsed due to lack of payment. What are we suppose to do? I am now having to make payments to my insurance company for my home. I have no idea what's going on with my property taxes. We, just like many other americans with TBW are making our payments on time. I have an excellent credit rating (or did have). How is this going to effect our future credit rating. I will not send another payment to TBW, however I will save my mortgage payment(s) until I find out what is going on. The web site has been shut down. You can't get anybody on the phone. What are we suppose to do? This is not our fault, yet we will reap the consequences. Where is the justice in this?

I have $575 on my credit card. I have to pay and Now I have to pay another $550 to the appraisers because they never received the first payment from Taylor Bean and Whitaker. plus delays in refinancing at a lower interest rate has cost us about $150 a month in mortgage payments that would have been lower

TB&W says that they have the money to pay off Cenlar for my old loan, but the judge will not release it. I get a different story and more run-around blah,blah,blah every week when I talk to them.
I've called Freddie Mac, but they won't do anything either to hurry the process.It seems like no one gives a doodie, and we (the consumer) are left holding the ****** *******bag!
Isn't there some way to get these issues resolved? I am told that there are THOUSANDS of people in my position. So, why doesn't TB&W start with one, then another, then the next - but no, they want to put everyone on hold and stick their heads in the ground.
Can't there be a class-action lawsuit for situations like this? It's only a matter of time before everyone's credit is ruined, compliments of TB&W!

Taylor Bean bounced a escrow reimbursement check to us when they went bankrupt. Multiple contacts and they still will not disclose when we can expect to be reimbursed. They will also not disclose who the bankruptcy trustee is. Now we have found through our new loan servicer CENLAR that we have been paying about $200 a month for the past 3+ years. Wonder where the money went.

I get no ansers from TBW about this but they still want me to send more money because they dont have it yet. They were also supposed to do a loan modification which now is all forgotten about. Is there some help out there for me beacuse I cant wait much longer and get money to pay these people?I would like some help before any forclosures start.

I have the same problem many customers of Taylor Bean & Whitaker have. My August payment is missing. I have confirmation from my bank, Wells Fargo, that my money was sent Aug. 4th. But Bank of America who now has my loan says they don't have it. I am now on a "delinquent" account type database.
I now get calls about my missing payment, every first of the month Sept and Oct. On October 1 and 2 I got a total of 6 calls inquiring about my payment. I spoke to so many people and all they say "we this is hard" and from the looks of it I will have to make a double payment to cover my taxes and my home insurance. I am out 888. I will have to make this payment. I am lucky to have a job, but there is a reason my mortgage is 888 becuase that is what I can afford now i have dish out an extra 888 to cover my taxes and insurance by Nov.

I have been with TBW for 1.5 years and never once been late. I logged into my TBW online account as on 08-05-09 to make my payment to find it was shut off. They directed to a 1-800 number to make the payment which we did. I called back on 08-10-09 to confirm it was received to find out that my loan had been transferred to B of A and that they would handle my loan. They gave me a new 1-800 number so we call B of A. B of A did have the loan with a new loan number but no Aug payment. They said it would be update by the end of the month.
On 09-01-09 we called B of A and they still did not have the payment, I started to panic and went to my bank to get a copy of the draft, so I could prove the payment. B of A would not take my Sept payment saying we were behind and had to go through the "home retention" department. 09-08-09 we received our first notice of foreclosure. We called again and they told us that was automated not to worry and to make our Sept payment. Since they let us make it we did, and faxed in a copy of our Aug payment.
We have since received to this day (30 days later) 25 letters for foreclosure 2 people have come my house to assess it for resale and numerous calls. I call weekly to see if my Aug payment has been put in the system and they say no, it could take up to 6 months but in he mean time they are reporting me late and actually told me I am overreacting. They let me make my Oct payment finally on 10-15-09, to tell me again that I was 60 days behind. I had to explain my situation again and they said to disregard the notices. I have faxed my Aug proof of payment to B of A four times and they still don't have. They are also trying to force me into homeowners insurance stating I do not have any, but continue to take my escrow payments out. I am really scared and B of A will do nothing to help. This is harassment plain and simple !!

I have been with taylor bean for the last three years. I was laid off back in January I fell behind on my mortgage payments in March.I applied for a mortgage loan modification and I have been going in circles with this bank.Now I found out that the bank went under in August by a customer service agent and I asked them so what do I do now? They told me I would reciecve a letter from the new bank who is getting the loan. Two months later I have not heard anything from them.

This mortage company kept my 8/1/09 payment they didn't tranfer it to bank of america.I don't have money to make up that payment.I sent 2 money order and they can't be cancel because they already cash them and now it's going to cost me $50.00 dollars for copys this is not right they need to pay for this. Or make this right for there customer.

My Mortgage loann was transferred to Bank of America. I received a letter from Bank of America dated August 23, 2009, I received it August 26, stating my last payment to Taylor Bean & Whitaker should be August 5, 2009. I did not receive a notice from Taylor, Bean and whitaker stating that my mortgage had been sent to Bank of America,I have my mortgage payment automatically and electronically paid from my bank account, my bank sent the September Payment to Taylor, Bean and Whitaker. now Bank of America says I am in default, I paid my payment on time, how can I be at fault, why can't taylor, bean and Whitaker send the payment to Bank of America?

Wheres our bailout when we need it through NO fault of our own? Trying to come up with August, Sept payments of 1200.00 when they've already deducted it from our acct. Time off from work trying to straighten this out.

I went and signed in on BoA and they don't show anything outgoing of my escrow. I managed to sign in on my Taylor, Bean & Whitaker account and saw that a disbursement went out on 8/04/09, but my county tax assessor says it has not been received. I can't get an answer from Taylor, Bean & Whitaker AND Bank of America says it isn't their problems. What am I to do? I have to come up with the second payment which I do not have. I've been paying into my escrow for this. My property could be put under auction if this isn't paid.

i had a mortgage with taylor bean and whitaker. on 7/31/09 i went on taylor beans website like every month and pay my mortgage. this time the website was experiencing technical difficulties. well my payment was due on the 1st so i wrote a check and ran to the post office so it would be post marked by the 1st. well on 8/27 i went on taylor bean whitaker website to pay my september payment. this time the site said it could no longer accept online payments. i looked into it further and found that they sold my mortgage to bank of america and listed a customer service number.
i then contacted customer service through the number given and they told me that they were getting all taylor bean loans but it had not processed yet, and to expect a welcome letter sometime in the next two week.two hours later i get an automated phone call from bank of america demanding my august payment. well guess what, making you payment on time to your original mortgage lender was not one of the options. after about 15 minutes of hitting every key and being verbally abused by the automated system who even refused to let me speak with a representative until i made my payment. the system finally gave up and gave me a phone number to the home retention team.
well i called the home retention team, and a male who had a accent similar to that of someone who was from india; i recognize this because my doctor is from india; answered the phone. after getting my name and social he immediately began badgering me about my payment. well by this time i had already went online and printed copies of both sides of my cleared check and my bank statement. so when i explained that i had copies of my cleared check, etc. he put me on hold. after a few minutes he came back on the phone and said he saw where i made my payment not to worry, that i could send my september payment to him.
well at this point i didnt know who was who so i certainly wasnt sending the payment to him, so i waited about 2 or 3 days. and called customer service at bank of america,and a lady, very friendly and actually somewhat helpful, explained to me that taylor bean had been shut down by the feds, that they forced bank of america to buy there loans, and game me my new account number, and the website to make my september payment. she assured me that the mess would get straightened out and my payment would be forwarded to bank of america. i then went to their website and made my september payment.
i received in the mail a letter a few business days later from the bank of america debt collection department demanding i make my august payment. this was even after i made my september payment to them. then a few days after that i receive a letter in the mail from bank of america saying they received my august payment from taylor bean whitaker. well at last its over finally i can go on with my life. well no.towards the middle of september i get a call from the home retention team, a politically correct term for their debt collection department. i can say this because the first sentence said to you is this is a debt collector. well i spent an hour on the phone explaining everything you have read to this point to this indian sounding gentlemen who again put me on hold, then came back and apologized. i then out of frustration explained that i am not the suing kind but i am tired of the harrassment, and getting the phone calls. he said he understood, apologized and told me i would not receive any further call from his department. finally its over i can go on with my life. not!
two days later i get another call from the same home retention team, and by an indian sounding gentlemen, maybe even the same one, so again i spend an hour explaining everything that you have read so far. this time however i said i am not the suing kind but i have had enough i will call three people i get one more call. hud, my attorney, and the news. he said he apologized but that their system is automated and he cannot stop the calls, he said for me to just ignore them. he also said to wait until after the 1st of october to make my payment because everything will be cleared up and my payment will be credited for october as it should be. finally i can go on with my life, not!
i go online to bank of america website today 10/2/09 i waited an extra day just to be sure. i first tried to pull up my account to see if i was properly credited for my payments. well i guess not because i could never get past the link that says you payment is late when are you going to make it. it would not let me see my payment history, it would only let me see the make a payment link. well i then called the customer service number. the automated system asked me all the pertinent questions to identify me in their system, it seemed to be working fine, then once i entered the last bit of info, it conveniently told me it was experiencing technical difficulties, to call back later. after i chuckled, i decided to go to bank of america on monday to deal with a person who has to look me in the eye, and explain things, and who i can finally give copies of the massive amount of proof i made my payments on time. see its funny with all the conversations, never did anyone want me to fax a copy of what i said i had, and i offered every time. maybe thats because they knew i was telling the truth.
well keep in mind that i have been ignoring calls from their home retention team ever since their rep told me too, and i have received 3 to 5 a day during business hours to this point. then the final straw. i get a call from them at 8:22 pm on a friday night. i dont know about most people but friday nights are my time. this time i answered. i again politely explained everything you have read to this point. then i got rude, i explained that its not my problem if you cant remove me from your automated system but that i was going to research and join in a class action law suit over the harrassment, i was sure that if i was going through this there was probably thousands like me also going through this. then he became rude, and this is what he said.
sir the problem is that we did not receive your august payment from taylor bean, and that i should disregard the letter i received that said they did. he also said that my argument is with taylor bean, not bank of america. thats when i in matlock form explained this to him.since you bought my loan on 8/26/09, there is no way i even owe you a payment for 8/1/09 cause you didnt even have the loan. if taylor bean didnt forward all the proceeds to you after the fact, then it is your responsiblility to get your money from taylor bean, not me. at that time i ended the call by saying i would go to the bank of america branch on monday where i will give them copies of everything, hold them accountable to fixing this thing, and make my october payment. thank you and have a good night.

I never thought I would see the day that a check from a bank would bounce but it was returned for insufficient funds. Now I have that charge as well. There seems to be no end to this madness. It sure would feel good to scream at these bad guys. As of today we have lost in the line of $8,000. Our credit score is in the tank even though we have made the payments and have the records to prove it. Ocwen is just too slow but speed up the process of forclosure. How can anyone sleep with this going on?

I am a former TB&W mortgage customer ( loan # 0001815360) that had my loan assigned to CENLAR (# 0029423415). I received notification of of this assignment in a letter from CENLAR dated 08/18/2009. I have my mortgage paid through a third party bi-weekly service, EQUITY ACCELERATOR. Upon receipt of the letter, I followed the steps stated on the back page of said letter by contacting EQTY ACC on 08/24 via fax with the information of the new CENLAR acct. # and the pymt. address. I received confirmation that this info. had been received by EQTY ACC (confirmation # 10076, per Jaime, 10:27 EST). Jaime told me that EQTY ACC would be able to process this change and make the Sept. 1st, 2009 regular mortgage payment plus a PRINCIPLE REDUCTION payment of $1037.08 per the terms of the EQTY ACC payment schedule. EQTY ACC had taken three (3) drafts out of my checking acct. (Aug. 3rd, Aug. 17th, and Aug. 31st) of $1037.08 each that were to be applied as stated above. I had attempted to contact CENLAR at the phone # listed on the letter, (877-680-5583). After dozens of attempts over several days I had received only busy signals.
On 09/03/2009 I contacted EQTY ACC to confirmthe payment and principle reduction had been applied to my CENLAR account as I had been told it would. At that time I received a COMPLETELY DIFFERENT response from EQTY ACC. I was told that the three drafts, totaling $3,111.24, were "frozen" in a TB&W escrow account, and that monies could not be released until approval was given by the bankruptcy trustees for TB&W. I thought this unusual as the Sept. payment had not yet been paid to TB&W, how could it be "frozen" by a bankruptcy trustee? I was told that the matter should be resolved "in a couple of weeks", and that I would not be penalized for any late charges and that I would be properly credited for my additional principle reduction payment. I was told that I would not have to do anything further to resolve this issue, because they would take care of it.
On 09/15/2009, I began making some inquiries as to the status of the situation. I made over 50 attempts to contact CENLAR at the phone # previously stated. I also sent an e-mail request for a representative of CENLAR to contact me. I never received a response.
Finally, on 09/16/2009, I got through to CENLAR via the 877-680-5583 phone # on the letter. I explained my situation to the young lady receiving my call. She did record the information but was very limited in her understanding of what could be done by CENLAR. She gave me a "concern department" number, which took me right back to EQTY ACC!!
I determined to get some sort of definitve answers from EQTY ACC when I called them again at the # she had given me. I spoke with both the man who answered the phone, and his supervisor, "Carlos", regarding my situation. Carlos did state, different from the supervisor I spoke with Sept. 3rd, that the money was not in a TB&W escrow acct., but in an EQTY ACC acct. He did say, however, that the money could neither be paid to CENLAR nor released back to me because the acct. had TB&Was the designated recipient of the funds, therefore the bankruptcy trustee had frozen ANY distribution of those funds. Carlos did tell me that I had protection for 60 days under the Real Estate Settlement Procedures Act (RESPA) against any late fees or negative credit because of this situation. I have just made my Oct. 1st payment direct to CENLAR. I am no longer using Equity Accelerator as a third party provider.
MY DESIRE IS TO HAVE THE MORTGAGE PAYMENT AND PRINCIPLE REDUCTION BE APPLIED TO MY ACCOUNT AS IF THE FUNDS HAD BEEN RECEIVED BY CENLAR SEPT. 1ST, 2009. IF THAT DOES NOT OCCUR, I WANT REIMBURSEMENT OF ALL MONIES PAID TO EQUITY ACCELERATOR AS I DID NOT RECEIVE THE FULL BENEFIT OF THEIR SERVICES IN REGARDING TO BOTH REDUCING PRINCIPLE AND INTEREST ON THE LOAN AS PER THE AGREEMENT MADE BETWEEN MYSELF AND THEIR COMPANY.

I refinanced my loan on July 24 from TB&W to another lender and was supposed to receive $1186 back from my escrow account. That did not happen as TB&W was seized by the FBI in August before my refund could be returned to me. I now cannot find anyone, even in my congressman's office, who can tell me WHO is holding my money and how I can get it back.

I hadn't received my mortgage statement from Taylor, Bean & Whitaker for the month of September. I found this to be odd as they usually sent them like clockwork. I pay my bills (including my mortgage) online with my bank. I made the payment electronically for August which cleared on August 12th 2009. On September 5th 2009 I received a letter in the mail from Bank of America (which was dated August 21 2009) stating that Taylor, Bean & Whitaker was no longer accepting mortgage payments as of August 5th 2009, and to mail my payments to Bank of America. Beings how I had already sent my payment for August to TB&W, I sent Septembers payment to Bank of America. Now Bank of America is looking for Augusts payment, but I have already paid it to Taylor, Bean & Whitaker.

In August I began getting notices from many different companies claiming they now owned my loan. The first notice was from Colonial Bank dated August 12, 2009. The second notice was from Roundpoint Mortgage Servicing Corporation, also dated August 12, 2009. When I called Roundpoint, the person I talked to could not give me any information about my loan (how much it was for total, how much was in my escrow account, what my interest rate was, etc.), but told me to send my usual payment to them anyway. After I searched online, I found many people reporting Roundpoint was a scam, so luckily I had not sent them any money. Finally, I got a call from Bank of America stating that they had my loan. For a few seconds I felt relieved, until I asked for my account information and realized they had all the information for my OLD loan before I refinanced. $955 in my escrow account, my old interest rate, etc.
I explained to Bank of America that I had refinanced and that loan they had the information for no longer existed. They told me it must be some mistake they would get figured out soon and not to worry about it. However, after a couple of weeks, I started getting delinquency notices from Bank of America stating that I was overdue, I owed them 2 months worth of mortgage payments, I would lose my house if I did not pay, etc. Every time I would call them and explain the situation to a new person and be told not to worry about it, yet the notices kept coming.
Meanwhile, I began getting statements for my NEW loan from Taylor Bean as if nothing was wrong and they were doing business as usual! I called them and they insisted they do still own my new loan, and said that they will try to "pull back" my old loan from Bank of America, whatever that means. When I asked about the $911 they owe me from my old escrow account, they claimed that they did transfer it over to my new loan, so they don't owe me any money!
I have 2 months of mortgage payments sitting in my checking account now, but I don't know who to send them to. Even though Taylor Bean insists they still own my loan, I do not know if I should believe them. Also, even if they DO still own my loan, I do not trust them to pay our insurance and property taxes when they are due now that I have heard all the other stories about them not doing this. I have contacted several lawyers, but none of them would even meet with me, they just say they don't handle cases like this. I also tried calling the local VA office, the person I talked to said they have just been directed to tell anyone with a Taylor Bean & Whitaker loan to "handle it through the banks." I don't know what to do.

I have used TB&W accelerator Program for a number of years without a problem. Recently my mortgage company, Provident Funding notified me that they had not by September payment, and I now have received a late fee. In another letter Provident sent it informed me that TB&W was in bankruptcy and that I should make other arrangement to have my mortagage payments made.
I checked my checking account TB$W takes weekly fee from my account, the last date of withdraw was on 8/28, will after their filing for Bankruptcy. I called my bank and had the automatic payments canceled. This took some work as they wanted the merchant to cancel the auto payment. Even after explaining the circumstances Citibank was hesitant to cancel without TB&W approval...I actually had to threaten Citibank with closing my account to stop the payments.
Whose money is it? What a nuts world! I am self employed in a down market which already has it's challenges. Now I have to somehow come up with money I don't have, pay a late fee (provident is unwilling to wave) in an effort to save my credit rating and my house. The result is that I will have to borrow money...with another interest rate to pay for something I have already paid for.

I made my August and September mortgage payments to TBW just like I have for several years. I make my payments through my credit union 'bill pay' option, where they remove the funds from my account, cut the checks and mail directly to companies for me. At the beginning of September (after I had already sent my mortgage payment) I received a 'welcome' letter from BOFA saying that I now needed to make my payments to them directly, beginning Sept.
Initially, I thought that this was a scam, because I hadn't received ANY notifications that the loan was being sold. I couldn't get a hold of TBW, and their website looked incredibly odd....and said to call BOFA. In calling BOFA, I found that they didn't even have my Aug. pymt credited to my acct and that they say I am two full months behind on my mortgage. To BOFA's credit it does seem like the people I keep talking to are aware that the TBW situation has been difficult and stressful....but just as soon as I am assured to calm down, and WAIT because 'every day they receive bundles of payments from TBW that are being posted to accts...it will take some time to process all of them'....
THEN I get a COLLECTION CALL from BOFA demanding that I pay two month's mortgage payment because I am in default. After explaining AGAIN the situation to the collector, they said they made notes on the acct and that all they could do is take my ph# off the auto-call grouping for a few weeks. After calling every day this week to BOFA, I decided to go directly to a branch close to my work to try to resolve this. The agent there called the customer service dept and they all reiterated to me that I should NOT stop payment on the Sept. payment because when those checks are processed, it would foul everything up even more.
This 'waiting' and 'trusting' is so hard for me! My mortgage (like most everyone else) is the biggest expense I have and the biggest financial investment I have! I used to work for a collection agency many moons ago and I do NOT WANT MY CREDIT fouled up at all over this! The stress over this is really killing me. I work hard and make my payments on time. Alway have! Even in this economy! I wish there was more media coverage over this issue, also I wish there was some sort of directive that could be given to BOFA from the Feds to lay off the 'strong armed' tactics for a few months until it gets resolved. In reading other's situations, I know I am not alone, but most of my collegues and friends have never heard of TBW and are unaware of what went down! I feel violated.
I am trying to trust the advice given to me by BOFA and just WAIT....but this is so difficult when there is so much at stake! There is nearly $3000 of mine in a black hole somewhere not credited to my acct. Seems like the Feds could have thought through some of this fallout prior to the shut-down. This is a nightmare.

We had our original home loan through Taylor Bean & Whitaker and refinanced through another company in July. We received our escrow check on Aug 22nd. We finally deposited the check in our account mid-September and just got notice from the bank that the check bounced. We had no idea that TBW was shut down etc.
So I called the FDIC who told me to call TBW and was told that all the assets have been frozen and they are working in court to have this taken care of. The cs rep. at TBW said we should get a check in a week or two, but she didn't know for sure. I said that is a weak excuse and you should know or someone should be able to give me a time line. When I asked to talk to a supervisor or anyone higher she refused to transfer me.
When I asked why weren't we notified that this was going to bounce she told me that since the beginning of Aug. we are not allowed to send anything out (ex. a letter or a call). I also asked if the company halted operations in the beginning of Aug. how was a check sent to me at the end of Aug. I am extremely upset and to add insult to injury the person who I talked to at TBW made it seem like it was my fault that the check bounced. I just don't even know where to begin and who to contact. I think this whole thing is fishy.

Well well looks like we are all getting harassed by B of A. Thanks right. I sent my mortgage payment with my coupon on August 7th to TBW. On August 21st I receive a collection call from B of A stating I am PAST DUE on my mortgage. I explain that they have the wrong person because my loan is with TBW not B of A. Much to my surprise I was told that TBW had filed Banko, Coloniel Bank was shut down by the FDIC and FBI and B of A was my new mortgage company.. Yay for me .. Not. I explained to the person that I made a payment to TBW it cleared my bank on 8/11/09 and they need to get the money from them. They told me at that time not there problem and that when could I make my next payment. Well I received a call everyday and night from someone at B of A and from India no less. The last straw was when they called me at work while on the phone with them already. I wrote a letter (6 pages) to Bank of America Home Loans, and Ken Lewis President of B of A. I also copied the FDIC and the Cash Comptroller for National Banks and Department of Justice. Well the calls have stopped but my payment is still out there. Frozen they say. Ken Lewis' assistant faxed a letter to me today, I called back and left a message. I am curious to see what they say. Do what I did put in writing and copy everyone above I listed. This is harassment and we all work hard at trying to survive in this economy as it is, let alone having our payments hijacked!

we had a home mortagae thur taylor,beam and whitaker for 3 yrs. we used a equity accelerator to make our payments. that is a company that takes 1/2 my payment out of my checking account per pay-day ( i get pay every two weeks) my payments are aways on time that way. this past aug the two payments were taken out for the sept. payment,this is went the feds went in closed taylor beam and whitaker my money is frozen until the courts can rule. when will i get my money back? i did nothing wrong i can't understand why the equity accelerator can't give me back my money they said that it's sitting in a account with them. it never was send to taylor beam and whitaker. i have closed my account with equity acc. and my mortage is with bank of american. i've had to scramble to make sept's payment please help i want to know if i will ever see my money again

I went to do my online payment in August to TB&W and it said my account was restricted. I couldn't figure out why. I couldn't get through on the phone that Thursday, and on Friday I finally got through to someone after being on hold for almost an hour and was given Cenlar's phone number and told that the feds had shut TB&W down. I called Cenlar and was given an address where to send my payment and that it would only sit there and not be cashed until after September 1 so I may a well wait for a letter that would be coming from them with a new account number, as I had not gotten any thing in the mail from TB&W saying that my mortgage had been sold to another company or any thing. So I waited and finally about week half later I got a letter in the mail from Cenlar with a stub for my August payment. I had also been told that payment coupons would also be coming soon, when I talked to Cenlar on the phone. I mailed my August payment approx Aug 28, and it did not clear my account until about Sept 10. I did not get any thing in the mail from Cenlar until 2 days ago and they sent me a coupon and a 2 page letter, the coupon says for payment due Oct 1.
There are no phone numbers on it to Cenlar for customer service, no mention of a statement as to how my August payment was applied, nothing, nothing but a website to sign into get account at Cenlar. I went to that website and there is no letterhead on it, just a generic page asking for personal info, including SOCIAL SECURITY NUMBER. No phone number, nothing on it. I am not about to do this as what dummy would put there ss# on a generic page? The only phone numbers that were on the letter that I received were for where to send your property insurance bill or tax bill. There was no mention of escrow accounts or nothing. It also said that I would continue to receive monthly coupons from them for my payments. The coupon wants my entire amount due which includes my escrow. Where is the money that I had in escrow. My taxes got paid for the ones due June 20, but now I wonder if my property insurance is going to get paid. I do not dare to send any money to any where that I don't get complete accountability for it, where there are no phone numbers and all the addresses on the letter are just po boxes, no physical addresses, and we don't receive any correspondance in the mail, no statements, nothing. What is going to be done with this so that consumers know what is going on?
I think I need to call my state offices and the local media. I have been patient long enough as I was expecting to get some thing in the mail by now to resolve this and I don't want to get behind and I want all of my escrow money that was accrued by them up until they take over. Someone needs to wake up. Next time my property tax is due is Dec 20, 2009, and you know that is Christmas and just because this is not getting taken care of do you think I want to forgo children's Christmas just because my taxes and stuff will not be paid? I have seen alot of complaints on the website but not have heard any thing in the media so I think maybe I need to find a channel that can find out what is going on. I would like an answer or some information, please. Alot of people have mentioned that they have been contacted by B Of A and other places. I haven't heard from any one except the two letters and payment coupons I received in the mail from Cenlar.

Paid August and September payment to TBW, the checks have not been cashed. FHA says do not send them money, they are closed. I keep getting late notices from TBW. The Florida Attorney General said they issued a Cease and disist order against TBW. What does that mean for me. I am afraid to send them any more of my money after reading all these complaints, the money is not being applied to our mortgages and the new companies are saying they don't know where the money is and to send them the money. If we have already sent it to TBW, most of us do not have additional means to send an additional payment. TBW website still says they have our loan. Does anyone out there have any useful information. I am scared we will lose our home because of their troubles.

I had gotten a couple of calls from an automated voice asking that I call BofA at my earliest convenience. Having gotten several emails from them wanting me to refinance I ignored them. Then I received a letter in the mail on Sept. 8th, 2009 from Bank of America with a notification date of August 23rd, 2009 Stating that as of August 5th, 2009 all future mortgage payments were to be made to them as TB&W were no longer in business. There was also a bill owing for the month of September. I called BofA to find out what was going on, of course, and was directed to the "Home Reclamation Dept", their fancy title for "Foreclosures". This was when I discovered the FDIC had closed TB&W down, their subsequent bankruptcy filing and my loan being sold to Bank of America. I was also told that any reports to credit reporting agencies and late fees were being held for 60 days according to Federal law. Knowing I was current on all payments I asked why I had had my contract put in that dept. The answer was that I was 2 months past due, which I knew to be impossible as I voluntarily have my payments taken directly from my bank account by another agency every two weeks for the monthly payment to be made the following month.
BofA claimed the August and September payment had not been made. I tried for over half an hour to get the person to understand that these had been made and were taken from my bank account. Finally I got a supervisor on the phone who also argued with me that the payments had not been made. Finally he told me the September payment may have been made but would be held by the court for two to three weeks and then the funds would be released to BofA. The August payment did not show at all. After another half hour I convinced him to call conference the company who had made my payments. At first he outright refused, then was very surly in saying he was not allowed to do so, but finally agreed after I told him I knew for a fact he was as I had dealt with erroneous creditors before. We spoke to the company, found the August payment had been made on time and the September payment had also been made but was, indeed, in the frozen asset accounts of TB&W. No further money was to be deducted from my account until this was all settled, then a new account with BofA would be set up. Until that time I would be responsible for making my payments directly to BofA. During this conversation the supervisor asked that all paperwork and documents be faxed to him, gave the agency the number, told me he could not stop the computerized phone calls asking for payments but the personal calls would stop, and hung up leaving me on the phone with the poor guy. He said it would be two to three days and everything would be sent to BofA by fax and I would receive paper copies in the regular mail.
Six days later I get a personal call from the collections dept., wanting to know when I would be making payments for August and September. I explained I had already gone over this with a supervisor and the documents should be in my file that I did not owe this money. He said no such documents were in my file at first, stating I needed to make a payment right away to prevent 'further action'. I then reminded him that by law I had 60 days, that I had already proven I did not owe any arrears, and it should be in my file. He then admitted that yes, it was in the file, but was not 'validated' therefore not relevant. I asked to speak to the supervisor I had spoken to before and was told he was 'unavailable'. I asked for another and was told everyone was busy, that I could call back the following day. I asked him why, when I had spoken to a supervisor who stated he would make a notation on my file, had the phone call recorded by 'quality assurance', had a third party witness the conversation and verification of payments, the entire process could not be 'verified'? His response was to continue to state that until I make the payments I would be receiving these calls. The only way to stop them was to fax a request for them to stop and explain my reasons. I do not have a fax machine, told him that the calls were already supposed to stop per the supervisor I had spoken to prior to this but did say if he wanted I could get a letter from my attorney stating harassment. He continued in the line of me owing and need to make payment and so on, ignoring everything I had already said. I hung up.

I had a mortgage with Taylor, Bean & Whitaker for two and half years. I was never late with my payment even during times of unemployment. In that two and a half years I paid them over $26,000 in interest alone! On July 22, 2009 I sold my home and paid them off. I recieved my escrow disbursement check in the amount of $1142.08 on August 24, 2009 which bounced in my account with no explaination from them.
I have jumped through hoops to try to contact someone to help me. This is my money! If the FEDS were going to freeze their accounts they should have completed their business first and made sure that their customer were not going to pay for the mistakes the this mortgage company was making!
Lets face it the government has our escrow money and the government is responsible for paying us back! I don't have my money, I'm currently unemployed (the reason I had to sell my home in the first place) and have three children to take care of. I probably qualify for assistance but, I am an american citizen that don't believe in food stamps and that kind of stuff.

Taylor Bean and Whitaker had my mortgage loan. I had an escrow with my account. They took the money out of my escrow account for my home insurance. It was never paid to the insurance company. I want to know where my money is? My insurance will be cancelled.

Short! Made my on-line mortgage payment (August 2009) as usual (I actually had this set-up for the year as to avoid being late(what I thought being a responsible person should do). the money was debited from my account (trust me, I checked with my bank and the money was indeed debited). It wasn't until September I find out that Taylor Bean went under. Band of America has my loan, but of course is stating/claiming that I am in arrears for August 2009. I explained and even faxed over proof of this - now no one at Bank of America can locate all of the research and paperwork I faxed over. According to them, I'm still late. Also, Taylor Bean never paid my home insurance but my insurance was included in my mortgage payment! Where's that money?! No one has it.

I too have a mortgage with TBW. I had absolutely no idea the company closed until I received a letter in the mail from an unheard of lender informing me they were able to DEFINATELY refi me. When I called them, they told me they were not licensed in the state of IL and they had no idea how I received the letter from them. I've called all the numbers associated with TBW, BOA, and any company supposed to be taking over my mortgage, without receiving any help at all. Most of the numbers are not even in service. I've not been able to make Aug or Sept payments. I've never missed or been late on a mortgage payment in 26yrs! We are in a tight situation to begin with because of a shady mortgage broker that promised us the world and unknown to us, over valued our home to get the loan in the first place. We were never able to see the appraisal. He was just interested in his cut. We can not afford to let the credit scores slip further. No one will touch us to help refi without any mortgage info. And missing payments does not help anything.

This has been a frustrating week for my family. We actually pay our mortgage a month in advance every month and have for the last 2 years since our mortgage was immediatly bought by TBW. Everything has been fine until a few weeks ago when I saw a letter from Bank of America. I had almost thrown it away as we are always receiving refinancing offers in the mail. It basically said that B of A was the our new lein holder and any payments from Augest should be forwarded to BAC Home Loans. Well by the time I had recieved this letter, in the fist week of Sept, I had already made 2 payments for September and October by cashiers check. This was unsettling to me and I called B of A to inquire about those payments. The rep said the file was in transition and not to worry as I had 60 days with no fees.. What? You owe for September. But I paid this as well as Oct. We went around on this and the rep suggested that I contact TBW. So I called them, and a female rep said that my cashiers checks were sitting in a lock box in Orlando Florida and there was no telling when they would be released to B of A. She also told me about how she had seen the pink slips handed out to the employees after lunch.
I then called back B of A and asked them my recourse at this point and was told it would be in my best interest to cancel the checks or just wait, After all I had a 60 day grace period that was ending Oct 1st. So I went to Chase with my cashiers check stubs and asked them to stop payment on them. Each check I send is clearly marked for which month the payment is for . They told me that Augest and Sept had bothe been cashed and they made copies of the canceled checks for me. I paid for an assurity bond to cancel the month of Oct and that was reissued. While in the bank I called B of A and said I had proof that Sept. payment was cashed already by TBW with Colonial Bank Orlando, Fla stamp on the back. The rep said that "unfortunatly" if I could fax a copy of the cancelled check to "payments research" that it would be credited. I then went in person to a Bof A branch and repaid Octobers payment and also had them fax the same copy again just to be safe.I also mailed a copy. I waited 2 days and called B of A again and was told that the payment I had made, was allocated for Sept. Eventhought Each check is clearly marked for what month. I proceeded to tell the rep that I had faxed proof of the calncelled check and was there any info on this.. The rep said that I was misinformed and it didnt matter if I had proof I would have to wait until aprox 30-60 fdays for everything to be allocated. I asked to speak to a manager who inturn was as unhelpful as all the rest had been.
Since Oct 1st is coming up quickly I made a payent again over the phone and was givin a confirmation number. She said she would waive the 20$ fee this time to pay by phone. Can you beleive this? I asked her what was I suppose to do if I didnt have the money to pay again? With no empathy I was reminded how thousands of others were in my same position and I did have a 60 day grace period. It gets better. My homeowners insurance naturally wasnt paid either and would be cancelled OCT 3rd. This was also in escrow. I was on a conference call with my insurance company and B of A. The B of A rep tried everything not to take the information to correct this and tried to push me on the website to do it myself. Oh and by the way,the website doesnt recognize my loan number. I know 30-60 days grace period. The rep even tried to say that they didnt do escow eccounts fo my insurance compay. Unfortunatly for him I am an insurance agent myself and work for an extremely honorable company. basically i feel that I have had my 1400 dollars hijacked from my family in these hard economic times. We try to be responsible and do the right thing by not only being on time and even ahead by a month for security. Im a cancer survivor and I dont need this stress. If I had numbly just accepted what the original letter had said and not taken the responsiblity to make those calls I probably would have received some not so nice letters in 30 to 60 days.

Checked my credit report today. TBW is reporting my lost August payment as a late. This after I disputed the other lates they are reporting for the summer! Is anybody going to do anything about this company? Is BofA going to be able to foreclose on us because TBW did not give us credit for our last two payments?

I have been assessed a late penalty for my property taxes. I am not sure if there has been any impact on my credit but I never pay anything related to my home late. My taxes have still not been paid & I am not sure what happens if your taxes are delinquent. My money is tied up in the escrow so I cna't pay my taxes, they have my money.

Received an escrow surplus check from TBW and deposited said check on 8/20/09. Was informed from my personal bank on 8/28/09 that the check was returned NSF. Not only am I out the $459.34 surplus, but $80.00 in fees charged by my bank (it's not their fault!). I've contacted Bank of America who assumed my mortgage and TBW and it's the classic pointing fingers at each other. BofA has been harrassing me with debt collector phone calls for my August 1st mortgage payment, even after I've sent the cashed check, front/back, proving TBW cashed the check. This is ridiculous that all of us are out money. I was told by TBW that they are trying to request the FDIC un-freeze their assets so that they can reissue all escrow surplus checks to customers. I hope so.

I had a Mortgage that I obtained through Reliance Bank of St. Louis, MO, and it was subsequently (immediatel) sold to Taylor Bean & Whitaker. Ever since I had my mortgage serviced by them they were at least 10-15 days applying payments in order to capture fees. Then I began paying online, and this was okay until one time I paid exactly the night before it was due, and they did not apply for 3-4 days and it was not over a weekend or holiday, and captured fees. I remedied this problem, by paying early. I never was truly behind or late. Then when I wanted to take advantage of HASP they acted like they did not know what was going on, took six weeks to reply, and 6 more to determine an offer of a loan to me, which was not according to HASP in its nature, and terms that were worse than I had. Then when I sold my house, they took forever (6weeks) to close it, and dated my escrow check from Platinum Bank the 4th August, and mailed it the 12th, and it arrived the 19th or after, and then the bank collapsed and the check bounced, and my bank Bank of America, took and wiped out my account, and charged me fees to cover the bad check. Mind you, this all happened as the FBI and Freddie Mac agencies raided and shut down TB&W, and TB&W declared Chapter 11. This TB&W had just bought the failing bank with their fraudulent funds, and my money. Apparently TB&W had controlling interest in this bank. There have been other arrangements for the other clients of TB&W, however not for those like myself whom were stiffed by both TB&W and Platinum Bank. There is no regulatory or insuring federal or state agency, or other mortgage servicer, or bank, that I have been able to locate or find re this situation. I must note that in my research, I have noticed that my own bank B of A is helping, and it is under investigation, and also the two other mortgage insurers that have been assigned to assist clients of TB&W are also in poor financial shape, and have been under regulatory scrutiny. My question: Where has the Obama Administrations' bailout money gone -my tax dollars, and where is the oversight, and where has it been? Geitner and Co do not seem to be handling this effectively.

TBW were recommended by our Remax Realtor in Montgomery, Texas, K. Thompson. P. Cloutier set up our loan with them. TBW have withdrawn payments on time bi-weekly for the past two years directly from our bank account. Now that the FBI has closed TBW, we are being reported to credit bureaus while our funds are being held by Colonial Bank in Ocala, Florida which has also been closed by the FBI.
Our credit is ruined. Our money for 2 months payments are considered deliquent since the government has the funds. The new lender, Ocwen, promised a 60 day grace period during the change over of loans from TBW to them yet they have changed their minds.
Poor Credit Score. They want over $3,000 to bring our loan current while we have already made these payments. No sleep. Stressed out! Our house is subject to being forclosed. Loss of equity. Loss of reputation and self-esteem. We live in China and every phone call to Ocwen is at our expense.

I refinanced my home loan in June of 2007 with TBW. We were told upon signing that TBW was a "good" company that rarely sold any of their loans.I signed up for the equity accelerator program which automatically takes 1/2 of my payment out of my bank account every other week and then pays TBW for me. I had 3 payments taken out in August which would have been my September payment and half of my October payment. I received a credit alert on Aug 15th on my email so I checked it out and found out that TBW had been shut down by the feds. The credit report showed that my loan was sold to Bank of America. After researching it some more, I found a phone number for BOA which I called and yes they had my loan, gave me the loan number and address to send payments to. I immediately called the program that was making my payments, gave them the new information and was told that the Sept payment would be sent there.
The next draft was to be this past Monday which never went through the bank. I called the program and was told all accounts were frozen and they could not make my payment or deduct from my account until the bankruptcy court released the funds. I wanted to cancel my service with them but they could not access my account to do so. I immediately went to the bank and put a stop payment on any further withdrawals from them. I am out a payment and a half and Bk of AM said I have 60 days from Aug 4 to pay the Sept payment or my account will be delinquent. Equity accelerator has my payment money, will not refund it and I can not come up with enough to make 2 payments before Oct. This was not my choice nor many others, why do we have to be the ones to suffer when we have been doing our part?

On July 30,2009, we received a letter confirming that our home loan had been paid in full and our remaining escrow funds would be sent to us within 30 days. A check was issued for $1748.00 on Aug 17,2009. I deposited the check only to have it bounce. I never received any correspondence from TBW regarding this transaction and when I called I could not receive any info as to when this check would be reissued. This is appalling to me as this is money that belonged to me and was in no way owed to TBW. I have no idea when if ever we will receive our funds. I just thank God we did not choose to refinance for a lower rate when TBW presented us this option in July.

The first week of August I went to pay my TBW mortgage online and their site said they weren't accepting online payments. Since this was always the way I pay, I found that odd and decided to call TBW 800 number to pay over the phone. After receiving busy signals for a week I decided to Gooogle the company where I found out that on August 4, 2009, the federal government shutdown TBW's FHA lending operations. I went to the HUD government website where it stated that all loans would now be serviced by Bank of America. I called Bank of America Home Loans Customer Service and was instructed to mail them my August payment. The payment was received and signed for on August 17. After that on a weekly basis I would call Bank of America to see if they had my loan. Each week they would say that their records were not showing that they had my loan, but to check back in a week as it may have been processed by then. Finally on September 10 I was informed by Bank of America that they did not have my loan and gave me 3 other companies to call (Cenlar, Saxon and Ocwen) all of which did not have my loan.
A couple days before this I had received a letter in the mail from TBW stating that I was delinquent on my account. I thought this was maybe an automated letter since to my knowledge TBW was no longer in business. On September 10 after speaking with 4 companies that did not have my loan I contacted TBW by calling a 800 number that was on the letter. To my surprise, I spoke with a woman who informed me that TBW still had my loan. I asked if I needed to mail my payment to them and she told me to wait until after September 15 as on that day a decision would be made on all loans remaining with TBW, whether they would also go to Bank of America, another servicer, or stay with TBW. In the case that my loan did go to Bank of America, they already had my August payment and I would just need to send them my September payment. On September 16 I called TBW and spoke with a rude woman who told me there was no such decision being made on September 16 and that I need to send them my August and September payments. I now have to put a stop payment on my check to B of A and I am nervous to send TBW my payments! Up until now I have never been late on a payment.

September 2009 payment mailed 8/26/09, still hasn't been posted to my account. I call normally each day and today I'm told my September payment is late.No one can tell wh where the payment is, only that "cashiering" is behind. I'm afraid to send Oct payment as I do not know if it will get creditied to may loan or not. So far Sept. has not, byt TBW says they are sill serving my acount. Servicing is a Joke, Any words of advise?

Like many of the other postings I too have not been contacted by TBW regarding the sale of my loan to another servicer. I placed a minimum of 7 calls in the month August requesting information about my mortgage and the new servicer but I never able to reach an individual. I was put on hold for a total of 5.75 hours in those 7 calls!
Finally, 8/15 I got thru and was told to send my payments to B of A, which I did 8/25 and was signed for on 8/27. Thinking I would receive information from B of A I assumed the check was cashed and the payment made on time. I have never been late with my mortgage payments and did not want the closure of TBW to affect my credit score. I called B of A after the first week of September as my check had not been cashed, there is no record of me or the check with B of A. I have not been able to reach anyone at Semloc either. I have no idea where to send my payments and to whom? Meanwhile I am very concerned about the existing mortgage escrow balance as well as my credit standing!
Does anyone have any additional information they can share as to what to do?

I closed on a HASP/Making Home Affordable refi with TBW on 8/6 and just found out Sunday 9/13 that TBW had been shut down - two days before I closed. I received my welcome letter from Cenlar a couple weeks ago and set it aside because I thought it was for my NEW loan, which wasn't due until 10/1. I found out about this mess from the internet - never had any kind of contact from TB&W or anyone else to tell me that my refi was never funded.
According to the Freddie Mac website, the new servicers are supposed to work something out with us on modifications that were in-process with TBW, but after 4 hours of trying to get through to an overloaded Cenlar customer service call center and finally sitting on hold for 25 minutes, I was told that my refi was so much dust in the wind and that Cenlar is not doing any modifications. As far as I can tell, Cenlar is just a loan servicer and not actually capable of modifying loans. So what are we supposed to do? So much for stabilizing the housing market.

online but in auguts we found that we were enable to do it,so we send it via express mail and in a few days it was returned so we send it again to the po box in ornaldo that appears in the weg page of TB&W and they received but my check haven't cleared in my checking acct.so I received my sept.bill and it says that we owe agust. payment so we send our regular payment for sep. at the same po box but it havent cleared neither and I don't want this affect my credit score and I have been heard a lot things and nobody answer me in TB&W phones and I tried to send an email but it was failure,tell me what to do,I havent received a letter from any mortgage company.

I had my home mortgage with TB&W and we escrow our taxes and insurance. TB&W sent out our insurance payment but our insurance company, State Farm, had the payment bounce on them. Then the whole goverment freeze happened and Cenlar got our account. However, the reported escrow did not account for the bounced check. Well, our insurance says pay up or no insurance. We contacted cenlar a number of times explaining the situation and they finally paid our insurance. However, they took it again out of our escrow. So now we are out $677.00 because we paid twice, and our escrow will be low for taxes so I am sure we will have to have our escrow increased.

In August I received my monthly bill for my mortgage payment from TBW. I normally pay the bill on 9/4 to allow for my paycheck to clear each month. Never has this been an issue. On 9/1 I received a cryptic voicemail message from TBW requesting a call to discuss my loan status. I was not aware at the time that TBW was in financial trouble. On 9/2 I tried to call TBW's offices with no luck. I then went to their website and found the heart-stopping message about their status.
I have not been contacted by any other mortgage company (BoA or Cenlar) or debt collector (Ocwen or Saxon) regarding my loan.
I've reached out to BoA and Cenlar and it seems that neither company has my loan. I do not want to contact Ocwen or Saxon as they are debt collectors and anything I send/say to them can be used in collections. I am current on my loans, I am not a "deadbeat" with my other loans and therefore it scares me to contact these companies.
My husband and I decided that we would hold our mortgage payment this month (Sept) because we did not trust sending it to TBW and have it go into the ether of their company demise. We contacted BoA (our regular bank) and they stopped payment on the check that had been sent for the Sept. payment and graciously waived all fees due to the circumstances. We also have $400+ in escrow with TBW that I'm sure is going to be close to impossible to recoup.
What is a consumer to do? Who can help those customers that have fallen into this black hole of uncertainty. I want to pay my mortgage to someone who owns it - the problem is that I have no idea who does.

We had our mortgage with Taylor, Bean & Whitaker when we bought our house in 2007. In May of this year, TB&W contacted us and asked if we wanted to refinance at a lower percentage rate. Since the economy had downturned and real estate values fell, they said it was an opportunity for "good customers like us who had always made payments on time" to take advantage of the lower percentage rates. All we had to do was take a test online to see if we qualified, and if we did, they would try to approve us for a refinance. TB&W would pick up all the closing costs, we would be charged for nothing. So after checking into it, even with hesitation, we went forward. From the beginning it was a situation that we had no control over. We had to wait for people to call us tell us if we qualified, there was a phone interview. Then we had to make an appointment for a notary to come to our house to do the closing. Mind you, we had yet to see any papers with any figures on them to guarantee us what our payoff would be, and that all the numbers matched up correctly.
I made numerous calls to TB&W, only to be met with people who didn't know what I was talking about & they didn't know what they were talking about. We were to get an HUD packet one week prior to our closing so that we could review everything. Did we get it? No. We didn't even get a confirmation from our notary that she was coming until 45 minutes before she arrived. When I informed her about the packet we didn't have, and that I couldn't promise her we were actually going to close, she said she had just received the paperwork herself. It was a mess. Needless to say when she got to our house, there were errors in the closing documents. The payoff information was incorrect, the escrow amount was incorrect. We were promised that we had three days to cancel, and were given phone numbers to call the next day to get everything straightened out. It was about 7:30 at night when she came and that was July 20th. We were given 2 payment slips and told to make our next pymt on Sept 1st. This new loan did not have escrow involved, so we were to get a refund. There was a timing issue with the closing and a tax bill that was due that I had sent in.
On 7/27 I called TB&W and requested they pay the tax bill early rather than wait till it was due. Four weeks later called our tax office and confirmed the bill had been paid. On 8/16 my husband sent in our 1st mortgage pymt for the new refinance. On 9/11 I went to our bank to see if it had cleared, it had not. I came home, looked at the letter we had received a week earlier from CENLAR (dated 8/16 but only received 9/3) and read it again. It only stated that our PREVIOUS TB&W loan had been assumed by CENLAR. It didn't say anything about our new loan(which we had a new loan number, etc.) So I called the TB&W phone number on the CENLAR letter. I asked the young gal who answered if she might know what happened to the check we sent for our first payment. No, she didn't know where it was unless someone stuck it in a file somewhere. I told her I was sure someone wouldn't do that and a mortgage company ought to know how to post a check when it comes in.
Then she told me that my old mortgage hadn't been paid off, so my new mortgage hadn't been processed yet. She said I needed to call my title company and find out what the hold up was, why they weren't releasing the money for my new mortgage. I explained to her it wasn't MY title company, but it was the one that TB&W hired! That THEY were the ones that needed to get them on the ball. Long story short-I called the tile company in Plano Tx, where THEY informed me that TB&W had filed bankruptcy, and they also told me I had better put a stop payment on that check I sent in for my "new" mortgage, because there was not going to be any new mortgage. I spent the rest of the day trying to get CENLAR on the phone to get that mess straightened out, it is still not straightened out, because now it appears that the payment we made in July to TB&W on our old mortgage also did NOT get posted to our loan. I can only hope that the check did not bounce to the tax office, I have not heard yet. If so, that will be another $1000. I don't know where this will end.

We had our mortgage loan from TBW. Before their collapse, we refinanced through some other company. However, the initial check of ~900$ for escrow account balance bounced. Besides this 900$, we have ~4500$ still in the escrow account. Hopefully, we will get our escrow money back from TBW. We are very tensed.

I had my loan with TBW, back in april 09 I filed for the Home Affordability Plan i made numerous calls to TBW to check the status of my application, needless to say sometimes I took some hours off work to be able to get through b/c of the time difference. Their where times that I spent at least 1 1/2 hrs. on hold just trying to get through, when I finally got someone all they would tell me is that i had to wait for a response they couldn't tell me anything else all I had to do is wait.
After the third month I decided to consult someone professional to represent me. They finally told this person that my application was denied b/c something was filled out incorrectly. Never got a call or letter from TBW telling me of their decision, so I resubmitted all my paperwork again, and stop making payments at that point I figured they would listen to me then. Sure enough after the first month of being late i got several phone calls (home, cell) from the bank to contact them at a 1800 number regarding the status of my loan.
Next thing i know is I get a letter from TBW saying that my loan was going to be serviced by OCWEN, never said that TBW was closing. I'm wondering from reading all the comments no one mentions OCWEN, only BOA and someother bank, does anyone else have OCWEN? Now it seems I have to start all over with my modification.
I don't know what to do I got my statement from OCWEN asking for the late payments (3 months). I don't know if OCWEN will work with me or decide just to foreclouse or help me out. I think they (government) should force TBW to compensate all their affected customers, that't the least they could do

I refianced my mortgage in july 2009. I received a letter from TBW that my mortgage with them was was paid in full and that I would be receving my escrow refund within 3o days. I received the refund check on 24 August and promplty deposited into my bank account on 25 August. I was informed on 12 September that the check had bounced and my account was charged a small transaction fee. I contacted TBW on 9/12/09 and was informed that a new check will be issued in a few weeks. I don't believe this will ever happen, as TBW has filed for chapter 11 protection. What recourse do us consumers have, since TBW issued the refund checks well after filing for chapter 11 and knowing that they could not cover the funds?

Due to changes in income in my household, I was unable to make my house payment and went into foreclosure. A friend of mine wanted to buy the house but it was too close to the courhouse sale date to do a short-sell.The sale was listed in the paper as $131K. He contacted Ms. Cline, who told him the bidding would start at $165K and they would not take less. Needless to say, it didn't sell. The house has been empty since the end of November '08. Today, I got a letter from Bank of America saying they had bought my mortgage and asking me to make my $1015 payment.

We closed on our house in FL in March 2008. We weren't in the house long and began having trouble with our mtg payments, due to two deaths in the family and my work hours being reduced three different times. We contacted TB&W each time to make some sort of arrangement. No luck. The last time I was told straight out that it was in their best interest to not work with us and just foreclose since we had an FHA loan. They would get their money up front from the government instead of working to help us keep the house. We went ahead and moved out in Feb 2009 rather than be forced out by the sheriff and humiliated. We received paperwork from an attorney in Tampa (our house was in Cottondale, FL, in the panhandle)in July stating the house had been sold at auction for $61,000. Guess who the "new" owner was- TB&W!! They had received the full $185,000 from the government when they foreclosed and then turned around and bought it back for $61,000. Isn't that unethical to say the least? Now I'm getting statements from Bank of America saying they own the house and to start making the regular pmts to them. When I called them, they had no idea the house had been foreclosed on to begin with. They think we still live there(our mail is forwarded.)

We have had two mortgage accounts since July 2008 with TBW. I typically make my payments via telephone, but when I went to make my August payment I rec'd a recording from Bill Matrix that they are no longer accepting payments for TBW. After doing online research I heard that TBW had been closed down and we would receive notice from one of the several loan servicers who would be taking over the accounts. I did receive such notification from CENLAR for one of our mortgages. However, we have started receiving automated calls from B of A asking to call in regards to our account, but when I call they say they cannot help me without a 9-digit B of A account number. I've never received ANYTHING from B of A, except several harrassing phone calls let alone an account number. I am now sending my August & Sept payment to B of A with a certified letter indicating that the account is a TBW loan. We have worked really hard over the past several years to make sure our credit score was as high as possible, and now that may be in jeapardy because of the incompetence of both TBW and Bank of America? Very, very frustrating.

I refinanced my mortgage with Taylor, Bean and Whittaker on Jul 17. I was supposed to receive an escrow refund of $1713.50 from Taylor Bean. On Aug. 3 I received a letter from them telling me that my loan had been paid in full and that I will be receiving my escrow refund within 30 days. So far I have not heard from them. I didn't call because my broker told me that they had gone out of business.

On July 20, 2009 we closed with TBW on a re-financed loan. We were told that we would receive our escrow check whith in 30 days. It is now Sept 11, 2009 and we have not received it. We understand that TBW has filed bankruptcy and all money is frozen. Also Bank of America has our old loan and they say it is still open and are asking us for our payment. Roundpoint Mortgage says they have our new loan and they are asking us for payment. FHA says the new load was not funded, yet our papers have a HUD number on them which mean that is was. Who actually has our loan? Where is our money? What recourse do we have and how do we find out who has our loan? We do not want to have any late fees or any damage to our credit report since we have never been late on a mortgage payment in our life.

We closed on a 203k FHA loan through TBW on June 18. The contractors were given the first installment of the construction loan money( about 15,000) at that time..the remainder to be paid upon completion of their work. They completed their work on 8/14 and by then TBW was defunct. I was told BOA would handle the loan from that point on. It's now 9/11 and my contractors can't be paid because BOA has no record of having the funds to pay them??? The contractors need their money and I don't need to be sued for it..my mortgage includes the amount they should receive and it SHOULD be in escrow but we can't find anybody at BOA who knows a thing about it..what procedure we need to follow to get the payment released or any other aspect of my loan..talking to them it's as if they have never even HEARD of a 203k loan...they are fairly common ...so what am I supposed to do with 3 contractors owed in excess of 14,000 dollars????? My mortgage agreement includes aprox 30,000 for contractors fees..I am paying BOA on that money so where is it?

The above company had my mortgage loan for two years. I refinanced in July 2009, my appraisal was good and I ended up with money to pay my taxes for this year. Which meant Taylor, Bean and Whitaker was to reimburse my escrow account in the amount of $1,520.98. I received a check and thankfully put it in my savings for future use, (hot water heater), on Saturday September 5th I received a letter from Members 1st, enclosed was the check I received from Taylor, Bean and Whitaker, stamped NON SUFFICIENT FUNDS. Then Members 1st took $5.00 from my account because of the returned check.
Waiting one hour on hold, I called Taylor, Bean and Whitaker today and was told that they knew when they sent the checks out that there was no money to cover them, they are in bankrupcty court and it's a case by case issue. She also said they were waiting for federal funds?!
I put my trust in Members 1st two years ago and got a mortgage, which they sold to Taylor, Bean & Whitaker. I had no problems with this company up to now. I refinanced and thought I was doing a great thing, saving money and now it's cost me an additional $1520.98 + $5.00 and no new hot water heater.

After being on hold for an hour and a half, I'm told by TB&W that they have claimed bankruptcy and the FDIC has frozen their accounts. My question is will I EVER receive my money.

I received a letter saying BofA is my new servicer. They show me not making a payment since July. I sent my August payment through electronic banking at Colonial. Colonial can't show the money going to TBW at this point. I need the money to pay BofA but Colonial has yet to put it back in my account. Colonial says they show the July payment going to TBW.
Late fees from being behind early in the year that I already paid TBW are showing unpaid with BofA. I paid them in one lump sum in June and my TBW online account had showed them paid.
I did a modification early last year with TBW. I think I got caught up in one of their scams. We had only been in the house a few months when they raised our payment saying there was an escrow shortage. When I called they told me if I had trouble making the payment to stop and they could help me in 90 days. That was a scary time but the re-did the mortgage with the interest rate in their favor of course.
I was supposed to get a check for being over in my escrow at the end of last year. I got a letter that it would come in Decemeber. I called when I didn't get it and they told me they applied it to the mortgage. I really don't believe that now.

Now I can not get a hold of a live person at Taylor Bean or the new company Cenlar. I read on the web that their bank Plantinum Community was taken over by the Fed's 5 hours ago. What does this mean? How do I get my money back? I am out $17,000 that is owed to me and suffered a missed opportunity in my brokerage account along with fees.

I recently refinanced my home with Freddie Mac which had Taylor Bean Whitaker as the servicer of the loan. I mad one payment to T.B &W for Aug-2009, and since the news of TB&W I have contacted Freddie Mac several time to find out who the new servicer is and they can't help me. I am 10 days passed due on September mortgage and can't find who to pay the mortgage to. I keep getting letters form different institution asking me to pay them my mortgage. But nothing from Freddie telling me who should I pay to.

TB&W charged me in 2008 for insurance on my condo building. I sent them a certified copy of the condo assoc insurance and was assured my $1500 would be credited (they had taken it out of my escrow). They never did, and I kept trying to get hold of them, and sent them letters with my payment. In the spring of 2009 they again took over $1500 out of my escrow, again for this insurance. I again sent them certified copies of the HOA insurance for both years.
I have mailed them copies, left phone mail messages, sent emails on their web site, filled out the insurance change screen several times,sent at least two dozen faxes with all the information and have never heard from them. Then in May I received a letter from them that since I had no money in escrow, my monthly mortgage payment would be increased by almost $400 dollars to make up that deficite.
I have been paying the extra money because I didn't want this to reflect on my credit rating. On top of all this, I just received a letter dated 9/2/09 that I had a past due balance of $440 that I needed to pay immediately in order to keep my credit rating in good standing. I went on their website to see what it was about, and their account shows no such balance due.
My payments have all been recorded in full and on time. I just found out about their "problems" today (9/9/09). I am not surprised because I believe I have been a victim of fraud. I cannot continue to pay the inflated mortgage cost. I am listing my condo for short sale and they can add the deficite to their bankruptcy filing!

TB&W was over mortgage servicing company. When I went to their website to make my payment there was a notice that they no longer were accepting on line payments and that someone would be contacting us. We did not receive anything until August 27th and what we received was a payment coupon that included no phone # or contact info.
I made the payment to the new company but was very nervous about it considering that we never received any notification for TB&W about who our new servicer would be. I have yet to receive anything for TB&W and would have had no knowledge if I had not logged onto the website to make my payment. The whole situation is very scary, not knowing who is handling my mortgage or if the payments are going to the right place.
We have another payment due and I have not recieved a coupon book, as promised, or a statement or anything. Why is their failure my problem? We have paid all of our payments and now I am not sure what to do next. If this affects our credit I will be devestated! We honored our committment but they have not and I am not very confident in the current provider as they have not provided us any info either.
We have been working very hard in the last 2 years to correct our previous credit problems, and there is no protection for us if TB&W or the new mystery company makes a mistake. Do we have to worry that TB&W didn't allocate our mortgage payments correctly? How do we know that they have done what they should have with the money we have been paying for the last 18 months? Are we responsible for their mismanagement? If they weren't filing papers correctly how can we know they were applying our payments correctly?

Recently refinanced our TBW mortgage and received escrow balance check. Went on vacation and came back to find out it was retuned to our bank. Unfortunalyet we spent it on our vacation. Was told FDIC is involved. Read that new checks our suppose to be issuied? What a nightmare!

We recieved an escrow check in the amount of $850.43 on 8/25/09 and the check was returned as non suffcient funds on 8/31/09. We have called everyone-are we able to get our money back? Nobody knows! Loss of $850.43 and $43.00 in bank fees.

I received a escrow refund check from Taylor, Bean and Whitaker in the amount of $403.81, when i took it to the bank the check was returned unpaid. I was charged $128.00 in NSF fees and the bank took the $403.81 from my account. I am out of $531.81, I spoke with Dawn @ TBW and she advised me to send a copy of the front and the back of the check, as well as letter from the banking stating the situation. My bank faxed that information to Dawn in the Ocala office. The letter was faxed on Wednesday 9/2/2009

The escrow refund check they sent bounced! Fees have just started to incur. Could possibly have checks returned

now i have accrued fees because of the holiday my deposit to cover this NSF check will not post til September 9, 2009 this is a huge mess. Will i see these funds ever again and who do i need to further contact because getting through to Taylor bean is near impossible!

We refinanced with TBW- closed May 27, 2009. Closing documents stated 1st payment would be due Aug 1, 2009. Follow-up statements in June and July from TBW stated same. Received letter July 29, 2009 stating error occurred, first payment actually was due July 1, 2009. Received this letter AFTER having sent them August payment (around August 7th). August payment was applied to non-existent July payment. TBW closed. Loan sent to BofA with loan "delinquent." Info given to BofA suggests we never paid August, and are now late for September. Keep getting debt-collection calls from BofA despite calling them on 2 occasions and faxing them several documents. There are no documents in existence with our signatures on them that indicate we agreed on first payment due July 1, 2009. I have asked BofA to review all of the loan documents to verify this. I am hesitant to send a payment to BofA for September, as they will apply it wrongly to August, and I will still be late for September. I feel TBW had committed fraud against us by changing the first payment due date to try and get an additional payment from us prior to going bankrupt and now that they are closed I have no recourse. We are at the mercy of BofA to review the legal documents and only hold us accountable to what we actually signed at closing, not what TBW has arbitrarily, illegally decided to steal from us.

We cannot reach anyone at Taylor Bean & Whitaker. Should we try to re-deposit this check or contact the Palm Beach County State Attorney's Office? Please advise. Loss of funds due us.

This is a disaster...B of A was rude, and threatened us with a bad credit report...through an automated response system. We were almost done with our modification when this happened, and now we are not sure what will happen, I only know I will not lose my home, we have 2 grandchildren we are raising and have worked hard to save to buy this home.

Dec of 08, I became delinquent of home loan, contacted TB&W on a loan modification, they then directed me to the Fresh Start program in which was affilliated with the mortgage co. They requested info I provided immediately, They directed me to several individuals during this process to submit my application, I allowed a few weeks to go by and heard nothing,
I repeatedly made phone calls , left messages with no returns. Having to go back to TB&W to redirect my calls to get assistance. The first fellow in which took application was on vacation and no one to return his calls. When he did get back in touch with me a few months had went by , he left me a voice mail stating he could only help me if i could submit 5 back payments in the amountof 4,759.70 and they would pay 2 payments in which would bring me current , I also locked in a 5% arm refinance.
I immediatly sent the money attn S. Haynes to the call center loan address, made sure my money was delivered through fedx and again waited for my packet that was supposed to be sent as soon a money was received. No packet came. Then I received a call from another agent a few weeks later stating he had taken over from the original agent, I stated well good maybe we could get this on the road. I asked where my packet was and he stated he was calling in regards to not having all the information in the file for the application! I was then extremely upset! I asked where my money was and that this application had already been approved. Told him he needed to speak to the lady i sent my check too.
In which a week later he returns call and says it had not been approved, I needed to resend info and that the money i had sent was applied to back payments with late charges all added back in. I recent info to get an answer of Im sorry I can not get this approved, I was out almost five grand and back to square one. At least i wasnt so behind on payments know. But now owe family members money back.
Just after that i received another Fresh Start letter from a lady, I called her she stated I was done wrong there is no qualifying everyone is approved, lets get this going asap and save our house, I downloaded all docs immediatley she sent me signed submitted info again for the 3rd time she asked for roughtly 2000 I pay two they pay two we locked in a 5.5% rate and to what prevailed.
Email stating TB&W is closed. Thank goodness i didnt sent the 2000 If it had of been another week i would have sent it we were gonna close the 3rd week and this is now August of 09. Something has got to give. If there is any help i need to know. I have just received letter from BOA that they have my loan and want payment in full.

I have paid statements from my bank I am paid 1 month in advance got letter today demanding $2359.31(includes late charges)Now they threaten to damage my credit with this .do we just keep making payment or what!

They sent me my escrow refund in the amount of 784 dollars and the check bounced.

Please someone advise those of us still stuck with TBW. Can they really be serios about late fees? I have honorded my responsibilities...they have not!

We had a mortgage loan with Taylor, Bean, & Whiteaker. We requested a loan modification,or our loan to be refinanced, and they sent us letters saying they were working on our loan modification. We received no response on the request for our loan to be refinanced. They never modified our loan, and they sold our loan.

After the FBI shut them down, I got a letter from them 09/01/09 saying to sent them my payment. I check w/BOA, Cenlar,Saxon,Ocwen, they do not have my mortgage, what am I to do, both my husband & I are retired & do not know what to do. Please give us some advise. Also my insurance & taxes are due. My Aug & Sept mortgage payments are now due, is anyone in the same boat as us. thanks

My escrow check also bounced on 8/29/09. I was also told that the "bank" was aware of the issue and that new checks were being sent soon. This is infuriating! I will wait for 2 weeks, I wonder what our legal options are? As customers, we should have first dibs in bankruptcy court.

We have been trying to get a "loan modification" or any other help for over a year. We were advised by TB&W to let the payments go to 3 months behind (we were at 2 months behind) before this process can start. We are still struggling and have gotten almost 4 months behind at times. We have been and are still at 3 months behind. We see no hope with coming up with 3 payments on our income.
The law office we used for the chapter 13 is Fuller & McKay of Rome. We have been talking with Julie about this. No one seems to want to talk to us since the lawyer is involved. We've now been told that TB&W has sold our loan and has been turned over to someone again.
All we want to do is redo the mortgage to include the amount in the chapter 13. We have enough in the house to do that. That should lower the payments and give me back what check I have. They are now taking $330 every 2 weeks for the court. I get paid bi-weekly.Is there another way to get this done any faster?? They have just turned it over to another company and said they won't even have our information on the computer for another week or two. Then we start over again!
August 27th, 09: I have just spent 30 minutes on the phone with our new mortgage holder, Bank of America! They gave me a new loan number and I have set up the information on their web site to view or pay on my account.
THEY HAVE NO INFORMATION ON ANY LOAN MODIFICATION OR ANYTHING GOING ON OR OUR ESCROW MONEY. Since this is a new account with them, I have to send them all the information and application to START the process. "It will take about 4 months" they told me, if we get approved!!
I went on their site and saw where they had an option to ask about doing a Refinance. I filled the form out and was contacted but told we couldn't apply because of the Chapter 13. I
August 28th, 09: I just spent an hour on the phone with a Consumer counseling service going over my options. We have much of none! My check needs to grow and the chapter 13 payment needs to be less. The loan modification would not include the chapter 13 payment or lower the house payment to do any good. I have been told from the start that they would include this amount and work it as to have one payment at a lower % rate. I now find out that is not at all possible, after a year!!
September 2nd, 09: We had 2 checks for payments that had been sent to TB&W during this month. I put a stop on both since they have not cleared my bank and we are not showing any taken from our payments due. We still have our tax bill but no signs of any escrow to pay it! This now puts us almost 5 months behind with a high tax bill coming due.

I have a home loan I took out 9/07 on 05/08 I contacted Taylor Bean regarding my relocation due to my job. My employer has a program where they would purchase my home. I tried to rent the home out but began to fall behing in 09/08 I took action to contact them and start the purchase process with my employee informing them that the process had a dead line and would mostly result in a short sale due to the housing market. I began the process placed house on the market and submitted the required doc via fax with and correspondent via email. additionally my home owners insurance was being paid via escrow i recieved a letter that my insurance was cancelled and they elected another insurance co which come to find out they own and increased my $1550 mortg payment by $100. My dead line for have a acceptance of my home offer expired on 4/13/09 with numerous emails, faxes and calls from myself and the purchasing agent we recieved no response from taylor bean. the deadline expired and my house is in foreclosure and my credit is in the dumpster. I have taken due process with all request only to have the CR not respond and during one call state they did not know who owned my loan.

Check was returned by bank.

If you are trying to contact Cenlar using the customer service phone number they gave in their notification letter (877-680-5583) it is perpetually busy. Try 800-223-6527. I spoke with a customer rep within two minutes.

I have now had a couple of experiences with Taylor, Bean that seem to spell out fraud. In April (2009)my mortgage rate went up $250 dollars. TB&W told me they did not have my common place insurance, or flood insurance policy on file. I have been insured on both policies since 2005 and was curious why all of the sudden these policies were no longer on file. I had both policies sent to T,B&W and the situation was cleared up for the month of May. The following month my mortgage rate was up $70 dollars. TB&W told me they did not have a flood insurance policy for 2007, however, I was covered in 2005, 2006, 2008, and 2009 with the same policy number. They withdrew the money that they felt I owed from my escrow account w/out permission. Futhermore, my August 2009 mortagae payment is missing at BOA. I have a bank statement for August 7th, 2009 saying TB&W accepted this payment. I can't get thorugh to anybody at TB&W to verify.

I have read most of the posts on here about TBW, and I contacted the FDIC on Monday that they reffered me to the Customer service number for TBW, 888-225-2164. I told them that number was dead, but they told me that TBW has hired a customer service to answer any questions. I called the number and after being on hold for 35 minutes a woman answered the phone and I explained to her that my Escrow check bounced and I am trying to locate my $6,000 and what they were going to do about all the bank charges for the returned check. She wouldn't answer those questions but she would say that they would try to replace the checks in a few weeks. Funny thing is she kept say the "Bank", when the Bank releases the funds. I asked what Bank, and found out that Colonial Bank Corp has our escrow accounts. They also own TBW.

I posted on Sunday. We also had our escrow refund returned as unpaid. I called BOA, they said since it was paid off, they can't help. I called the FHA line and they can't help...so I called TB&W at the butt crack when they opened at 8EST and was on hold for 10 minutes...talked to a very nice rep, she said that they are aware and that new refunds are to be mailed in 2 weeks...I hope she wasn't saying that just to get me off the phone...lets all hope this is true!

I have called BOA several times the first time I called they told me they took over so many loans that they would send me a welcome package at the end of August, so I never recieved anything so I called back now they say they are not the only ones that took over the mortgages so I said do I send my August payment to you she said thats your call I said can you check to see if you have my loan she said no, we have 300 thousand loans to upload and they are not uploaded and we are not the only ones that took the mortgages over but you can send it to us if you want. Now is that not crazy? What if I send it to Bank of America and they didn't get my loan? do they send it back? cash it? I don't know what to do I just don't want to get my home foreclosed on and I got a letter from Taylor Bean and whitakers attorneys where they want to take me to court about some late payments. All my payments are up to date except for August . I just want to know what to do and where to send my payment so me and my kids aren't living in the streets from them forclosing on our home. What a mess and everyone I talk to does not have the answers where to send my payment.

We have been notified by three different mortgage companies stating they have bought our mortgage. We are holding our payment until we receive something official from Fannie Mae regarding who we are to pay. Can you explain a process of determining who we are to send payment. We have received a notice from TBW that we are to send it to them but are apprehensive about doing so with all of the news reports. TBW is not available for a response.

I too am in the same boat as everyone else. Just a heads up, I have been keeping up with all this garbage. Everyone ggogle ocala florida news and it will bring up the star banner. I think you will then know why your escrow checks bounced! This has been a nightmare and I can only hope it will get better. Almost Foreclosure. I am glad I am no longer their customer, my only hope is BOA is better. I still have not received my welcome letter or anything. So far, BOA has been very helpful over the phone.

Thank goodness we have sufficient funds in our account otherwise we could've had checks bounce. We have contacted Congressman C. D. Rodriguez to help us with this matter. Perhaps if everyone who has encountered problems with TBW contact their local Congressman, we can all receive the money which is owed to us.

They cleared the funds- so I used them - and now. 3 days later- they have noted on my account that. the check bounced- and I'm NEGATIVE $1800 - I can not pay my mom's rent or food for the month now- I can not get anything but a busy signal at TB&W- WHAT DO I DO NOW? This $1800 is OURS- HOW do we get it back!

Tried to make payment with Billmatrix in Aug., they are not accepting payments from TBW any more. Called and emailed TBW many times, no reply. Mailed Aug. mort. check, as of today, not cashed. Called BOA, they have no info on me. What the heck do I do now? Just wait? So frustrating! Taxes and insurance not paid. What happened to $ in my escrow account?

I feel that if Bank of America bought these mortgage accounts they should do something about our surplus escrow money that was basically stolen...but everyone just passes the buck. We are looking into getting rid of our escrow account so this does not happen again.

TB&W owed us money from a recent refinance with another company. Customer no-service took hours to reach and they finally said...The escrow check's in the mail. Yes, we got the check, but it bounced. Now, there is no one to be found at TB&W.

taylor ,bean.my mortgage company has filed for chaptor 11.i did not recieve anything,to let me know where to send payments.taxes are do soon,i dont know what to do.please help.

I have been in contact with Taylor Bean since April 09 trying to get some modifcation due to hardships. I finally had someone contact me after 4 months of calls, emails, and faxes just to tell me that they are letting me know they have recieved my inquires and will be transferring them to modifications department. At one point I was told I could do the HSAP program then they told me that they had made a mistake. I am being transferred to modifications--well I was already at modification department.
Now I received notification my loan is with Cenlar, I have been trying to contact them but I keep on getting a busy line. I looked online and it seems as though they have increased my escrow and my payments. This has been an awful experience. I am unable to inquire about anything to help my mortgage because I cant get in contact with any one. I am constantly worried and would appreciate any help or information I can get on how to rectify this situation.

After our mortgage went to Bank of America, we had an escrow reund check show up; we called TBW to find out that our mortgage was sent to Bank of America and after everything was settled, there were extra funds in our escrow account and that was what the check was for. We deposited the check, only to find out a few days later the check has BOUNCED. Now we have incurred fees for depositing the check, which should have been OUR money to start with. Are there some legal ramifications here? This really makes me think twice about having an escrow account with any bank.

We refinanced and paid off our TB&W loan in 7/09. I tried for weeks to get thru to see what our escrow refund status was...finally 3 weeks later, I get our refund...just a few days ago, our bank said it was returned "UNPAID"...are we ever going to see that money??? over $2000 of our money and we can't get it or reach anyone to say what the heck is going on...any help, anyone in the same boat???

I have been with TBW for over 4 years now. I refinanced my loan 2 years ago and was attempting to get a reduced interest rate. My payments were set at a fixed interest rate yet my payments have gone up every year and TBW has continued to say that it was the taxes and insurance. I contacted my insurance company and they stated that my payments should not be going up as they had not changed anything. My property value has declined drastically and my taxes have dropped, yet my payments went from under $1,000 a month to $1200 a month. I ahve been trying to get in touch with someone to find out what is going on and continue to get no answer. A coworker informed me of TBW being shut down and I have not received notice as of what to do. When my payment went up again I was forced to borrow money from my retirement account to make my payments current because TBW would not take a prtial payment or attempt to work with me. Where do I go from here?

My husband and I built our retirement home which was financed through TB&W two years ago. From the time of our first payment, we made additional principle payments in order to save as much interest as we could. All payments were made on time and handled without incidence. In June, we refinanced to secure a lower rate of interest, and TB&W accepted our new mortgage loan. We made our first payment on August 6th with an additional 17 principle payments (to the penny). I received our estatement on the 7th, only to discover that TB&W had not posted my additional principle payments as requested on my payment stub. What they did was post four additional house payments (with interest taken out) and then with the remaining amount going towards my principle. They have since passed my loan to Cenlar who recently notified me via mail that our next payment would not be due until January. Of course their current amoung of our loan is nearly $2500 more because of their failure to place the additional payment directly towards our principle. Our loan clearly states that we can prepay at any time without any penalty. Can they do this?

county Tax Collector for 1730.49 that was taken out twice (12/11/2007 & 12/20/2007 for the tax id 44607. This does not belong to me. Then in February of 2008 the taxes for the correct property id 44171 were paid late in the amount of 2202.63 with a penalty of 154.18.
On the April 30 2009 Tax and Insurance Account Disclosure Statement there is a disbursement for 2946.06 paid in december of 2008 for county taxes,there is also a disbursement for 134.01 late fee and 1914.48 for county taxes paid in February 2009.
We have continued to pay taxes on both property IDs since 2007.

We have a conventional non-backed 15 yr mortgage. There was no info on the website about who would take over these, but received a letter from Cenlar with first payment date of 9/1. I did not make my Aug payment as it was not withdrawn and I don't trust the money to go the right hands. An extra payment was added to the end of my note. I take that to mean, I am being billed for remaining payments, (including aug) starting 9/1.
Those of you who have sent cashier's checks. They can be canceled like any other check. This is not widely known, but true. I guess I would rather have a mark on my credit than give a company a bunch of extra money, then fight to get it back. You can always have a note put on your credit regarding the mixup with the companies. When all settles down it will be easier to communicate with these banks and have things handled effectively, I hope.

I have also recieved notice that my TBW mortgage has been transfered to Cenlar. By the time I recieved notice I had already mailed my Set. 09 payment. After reading on this site I decided best to stop payment on the check cost to me 29.00. I have now mailed a new check to Cenlar in hopes that they truely are my mortgage holder. Cant reach anyone at TBW by phone or email and cant reach anyone at Cenlar either.

My loan was transferred. My taxes were not paid. My escrow is missing. I am now being serviced by Ocwen and cannot contact them by phone. after call is transferred it either hangs up or indicates that the number is incorrect. Trying to make a late payment and it cannot be accepted online. It has cost me time from work trying to resolve this since I had to sit on the phone with TBW for over an hour everytime I called and now Ocwen! I think all mortgages should have interest rates reduced, brought current, and payments reduced in order to survive! The mortgage companies cannot handle this!

Called to see why I couldn't make electronic payment. Was told My accouont was "restricted" and further that because I was in "Breach of Contract" they were sstarting foreclosure against me and could not accept my payment. My father in law was my co-signor and he passed away so they've declared me to be in breach of contract. They said it didn't matter that I was not 30 days late. I mailed my payment certified reutrn receipt but haven't gotten my receipt yet. I ahve a small child, wife and Very sick mother in law. I work out of state and drive close to 3 hours a day. The stress this has put on myself and family is almost unbearable. I don't know what I will do.

After trying to make my August mortgage payment online - I couldn't because of restricted...Tried to call but could not get through (busy signal). Called the FHA hotline and was told to mail my payment to Bank of America, located in California. I was told that I would receive notification as to the new holder of my mortgage, so far no communication. All attempt to contact anyone has been in vain. I am really apprehensive about sending my mortgage to anyone without notification that I am an account holder. What to do?

Unaware of the raid or the pending change in my mortgage processor, I mailed a replacement cashier's check to TB&W on August 8th. Yesterday, I received a welcome letter dated August 18th from my new mortgage processor, Cenlar in Minnesota, informing me that my Freddie Mac mortgage loan, previously serviced by Taylor Bean and Whittaker, was transferred to Cenlar for servicing, effective August 12, 2009. The letter included new instructions for making loan payments, said that TB&W stopped accepting payments on August 11, 2009 and showed a due date for the next payment as August 1, 2009!
I created an account on Cenlar's website and sure enough, that cashier's check has still not been applied to my mortgage. Needless to say, the old TB&W phone number has been greeting callers with a busy signal (or dropping calls while on hold) for weeks now. So, I called Cenlar to find out what happened. Instead of the answer, I heard, "Due to unforeseen circumstances we are not able to service your call.
I placed a call to Freddie Mac - they have a special set up to deal with former TB&W customers. The lady I spoke to verified that my loan was a Freddie Mac and said that Cenlar will be able to answer my questions as soon as they start picking up their phones soon. (Very useful - NOT!) She had no further information and was unable to tell me when "soon" may happen.

Use EXTREME caution in dealing with this company. If you have made a mortgage payment in recent days, call your bank and STOP payment ASAP. They have apparently gone bankrupt and sold remaining mortgages. Please stop your payment now to avoid getting burned. I hope class action is on the way?

My complaint is the non-responsiveness of Taylor, Bean & Whitaker or TBW. I received a letter from Cenlar that they will now be servicing my mortgage loan and not TBW. Cenlar included a payment slip in the transfer announcement letter. When I attempted to call both Cenlar and TBW, their phones were not working. I eventually called Freddie Mac to gather more information, since they are my lender. Freddie Mac confirmed that Cenlar's payment address was correct and that the transfer of the mortgage services actually occurred as stated in Cenlar's letter. Freddie Mac also informed me that Cenlar's phones will be working next week. And, I should wait until I contact Cenlar before sending the payment. In addition, I called my county Government to ensure that TBW had actually paid my taxes, for the first half of the year, in which TBW did pay my taxes on time. For those affected by the TBW collapse and have a Freddie Mac loan, the number for Freddie Mac customer service is 1-800-373-3343. I highly recommend calling Freddie Mac and your county Government.

I have been with TB&W for 2 years and never had 1 problem with them. I was totally shocked when I went to make my payment on line and was advised it was "restricted". Well, I thought it was a technical issue and attempted to call the office. I never could get thru. By this time, I am frantic with panic trying to protect my credit I have worked so hard to regain from destroying in my younger years. For three days, I kept calling the office and checking on line to see if I could make a payment. NO LUCK without any information. A co-worker of mine in which her mortgage was with TB&W before she refinanced was kind of enough to take the time to find out was going on with the co. To my surprise, FEDERAL INVESTIGATION!!! BANKRUPTCY!!!
So, here I was (like many of you) confused, afraid, etc. Oh, did I mention, there was a physical address on TBW website to send payment and I spent $17.50 overnighting the payment only to find out this disturbing news two days later. My co-worker printed off a notice she found from TBW and there were seversl numbers available based on the status of your loan. I was such in a panic, I called the first one I seen which was Saxon. The gentlemen re-assured me there was a law that protected people loans like ours in the event a compnay transfers you loan. He stated for 60 days from the time of transfer, the company that picks up our loans can not report our loans to the credit agencies at delinquent or assess fees. This is only form the time of aquisition and with that being said, I placed a stop payment on my check until I hear from the company that holds my loan. My account is escrowed and I refuse to give TBW any more money to possibly to whatever they want to do with it. Event though I have never had a problem with them, I am very concerned with them transferring all of my escrow monies to the new company as well. I hope this helps someone else out there dealing with this type of behavior from TBW.

i was in processes of mortified my loan with tb&w i send all paper work they request two weekes when by and i dint hear from tb&w i learner from law firm in florida that tb&w shutdown by federal gourmet try call tb&w for three days cant get hold anybody please help

I have a mortgage, owned by Freddie Mac that was serviced by Taylor, Bean and Whitaker. I was in the middle of a refinance that was supposed to close in September. This refinance was under the DU Refi Plus program as I dont own 20% of my home. Frankly, I dont believe Ill own 20% of my home for decades and because of that, no bank will refinance my loan, the only hope I had was under this program.
Cenlar now services my mortgage. I called yesterday and was told that Cenlar does not honor this program or do refinancing. My current interest rate is 7%. My refinance under the DU Refi Plus was going to be 5.75%.

TB&W has filed Chp. 11. My mortgage payment for Aug did not clear bank. Cannot contact by phone or email. I am not sure what to do. Am concerned about my tax escrow.

refinanced away from TBW, they still have my escrow, I am still owed over $2000.00 to pay my taxes and insurance. have not heard a word from them not even notification that the loan was paid off. I originally tried to refinance through them but got no where with them kept being put off. I need my escrow. Help!

i have 2 entities asking for my next mortgage payment, previously serviced by taylor, bean, and whitaker. one is round point mortgage (866) 559-8717. the other is cenlar (877) 680-5583 to which no live answer. searched and made numerous other calls to no avail. advice, please?

It has always been difficult to get in touch with anyone @ TBW. I recently refinanced, but have always had my loan with TBW. The refinance took much longer than they kept telling me, there was difficulty in getting payoff infomation from them, etc.
In August, like many others I couldn't make my online payment and became a little concerned. I couldn't get through all afternoon yesterday, but I did get through this morning. I called right at 9am and still had to wait on hold for 25 minutes. The person I spoke to said they were no longer servicing loans. Ultimately this person told me that my loan would be serviced by BoA and they gave me a phone number to call.
The guy, Roy, @ BoA was really helpful. He said that normally when a lender acquires another lender's loans, all of the information is transferred before hand and the transition is pretty seamless. This was not done in the normal fashion. TBW had no idea that this was happening, so all of the information transfer has to take place after the fact.
Roy also said that he had taken 5 other phone calls from TBW borrowers, and 2 were in the system already and 3 were not. He said they MAILED out "Welcome to BoA" packets on Friday and Saturday so people should be receiving them any day now. He also said that they were EXTENDING THE GRACE PERIOD on loans due to the circumstances. Look into it for yoursel...I'm sure they will have information on their website about phone numbers to call.
Use common sense. Don't give out information over the phone. If you think the caller is legitimate, ask them for the name and phone number of their business so you can call them back later. That can deter someone from trying to get your information. I'd like to think that the FHA would not allow people holding these loans to be charged late fees, lose houses, etc. Look through your financial records and find your mortgage info so that in the event something isn't right with your mortgage, you have info to back it up.

I tried to contact Cenlar but no luck getting through to anyone there. Like most who've already posted, I'm worried about this hitting my credit report and also about the PP tax and homeowners insurance payments not being made.

since jan of 08 have been trying to get a response from them as of this time i want to try and do a loan modifacation. no help. now i am 9 payments behind.no one to talk to. do i just wait for the sheriff to come knocking on my door? as of aug 22 i received a 1 page letter from colonial bank saying they now have my mortgae. are they not with tbw and under the microscope too? my taxes have not been paid for the winter (1526.00) and as of july of 09 have no insurance and am paying monthly.

I am in the same boat as other TBW customers. I was is the middle of a the Freddie Mac Refi program moving from 5.75 to 5.00 with no closing costs.
Now our loan has been transferred to Cenlar and they do not do any kind of refinancing. They offered no help on what I can do. No phone numbers, no support, no help at all. If anyone has any support contact info please post because it would be much appreciated.

i received an letter yesterday telling me that my loan was now in the hands of cenlar, and no longer with TBW. i was never notified by TBW about this transaction. i was in the midst of refinancing our loan, and now that is obviously out of the question. that process has taken over 10 months, and we still haven't closed. don't bother calling TBW, because you can never get through. always on hold.
i'm sick over the wat TBW has handled this. my payments came out automatically, thus they were paid on time every month. we even payed more each month, and we can't even get a letter from them with an explaination. why do they get the opportunity to re-structure? if clients have financial trouble, the banks take away their homes. business file bankruptcy and just change their names and continue functioning.
i'm really corked. time to take my business to a local bank (which i should have done in the first place.) but tbw SCHMOOSED ME!

I've tried to get a hold of Taylor Bean & Whitaker for a week now to make my loan payment for August 2009, but have been unsucceessful. Everytime I call, I get an automated message stating their office is closed. i have also sent my tax bill, and i was told by my county that they still have not received paynent through TBW yet...in the mean time, i'm accruing late charges...is there any one out there in this same situation?

I was very disturbed when I discovered that TWB went out of business. August 24 I finally did receive correspondance from Cenlar that they have taken over my current mortgage and included a payment coupon. Phew!

When you call you are on hold for a minimum of 1 hour then you get hung up on. I have been hung up on at least 4 times that i have tried to call. Now they are going under i dont know what to do or who to contact i will have to go into foreclosure if i cant get any help.

Had a Taylor Bean mortgage at 6.3 percent requested a modification in May and was accepted at 5.3 they told us then that it would be two weeks. Recently we were unable to pay our mortgage payment which had always been current because thiscompany on August 5 was raided by federal agents all records were seized and we have no access to any of the loan documents or even emails.Our escrow of 6,000 has disappeared and our insurance has lapsed.we cant even make a payment because we are unsure who to pay. These people got 900 million in tarp money and did nothing but steal from people

TBW had financed our refi in May (7-->5.5 which was excellent). We have had no issues till (obviously) recently. Luckily, my broker sends out a newsletter and alerted all TBW customers of the issues and advised to call our broker directly. Also, we knew our loan would be sold to another lender because i had called to complain that TBW didn't take partial payments (2 pmts/mo), and TBW said i was going to be transferred after 3-4 months of timely payments, which was fine, so i had a head's up already.
I have called B of A every week to see the status of our mtg and we are now nearly complete in their system, however, they are not able to accept payment as of yet, so they advised me to keep waiting for the intro packet with payment details and that there will be no negative reporting since the August payment is still sitting in my bank account.
The experience was a bit tenuous, but i have been diligent about checking weekly with B of A just to be sure. I also called the direct B of A number, and would distrust anything on a supplemental mailing flier due to the rampant fraud out there.

I made many phone calls and was promised and told that since there was many loans the wait was longer than they anticipated. Now Taylor & Bean has been taken over by another company.

Fraud! I recently refinanced away from TBW. They sent me a check for my Escrow balance, over 6 grand and the check was declined! TBW was obviously using their clients accounts to fund their failing mortgage portfolio. TBW stole 6 grand from me and I have no clue how I can get it back. Help Please!

Now im under the impression that everything will be sold to BOA. BOA nor TB&W have contacted us to inform us on what to do or where to go from here. We appreciate everyone posting their thoughts. Comforting to know we are not alone. Please help!

I have received letter from RoundPoint Mortgage Servicing Corporation to make payments to them for our TB&W mortgage loan. Also received letter Colonial Bank that they own our mortgage note (?) But reading news reports I understand Colonial assets are owned by BB&T and from TB&W website I see BOA will service GINNIE MAE loan, CENLAR will service FREDDIE MAC Loan. If loan is not current servicer will be either SAXON OR OCWEN. Very confusing and I'm afraid to send Sept. 1st payment.

I found out today at 10.30am, 3 hrs before settlement, that my mortgage is not being serviced through Taylor, Bean and Whitaker. Apparently they are out of business. I am now trying to get Cenlar (new mortgage holder) to give as a payoff. Who can help here? This is a disaster!
I have moved my family out of my home, that we have sold, and are going to settlement at 4pm today. The buyer is there with a moving truck, we cannot settle because the new mortgage company will not respond (busy signal or no answer). I guess I have to call not only my Senator but go to a local TV station and tell them that all this talk about good and fast service is a farce. If you respond via email, I have given my realtors email, we are moved out and have no email at this time.

We refinanced with TBW about 5 months ago thru a mortgage broker. The approval process was lengthy and dragged on for almost two months.
It didn't take us long to figure out that this company was incompetent. After we had already made our first payment, they sent a letter requesting that we send in additional information...things that we included during the approval process and closing. We tried to contact them to ask them about this, but they NEVER answered their phone. Finally, we just ignored their request. I didn't want to send them confidential information thru the mail. Who knows what they would do with it.
Then, a couple weeks later our insurance company contacted us, saying that we had two weeks to pay our homeowners in full or they would cancel it. We thought that it mus be a mix up because we switched mortgage companies. It turned out that TBW only paid the premium, not the increase. We sent TBW a check to pay the insurance company (b/c that's what they told us to do). The check was never cashed. Still don't know what ever happened to the check. Finally, we drove over to our insurance agent ourselves and delivered the check.
Now, they send us a letter (that looked like junk mail) saying that they've sold our mortgage and they can't accept payments after August 12. That's great. The letter was dated August 18th. And we received it yesterday (August 24th). We had already sent in an EPayment and had to call the bank to cancel it b/c TBW isn't answering their phone and the new company had no clue what was going on.
All we want to do is pay our mortgage every month. How fricking hard is it to take our money??? TBW is the worst. It's no wonder they are going under. Fare thee well...

I purchased my home in September 2006. Taylor bean paid my taxes based on unimproved property then issued me a refund for my escrow in 2007. I called them immediately and told them that they had made a mistake. They told me they were right and I was wrong. I assumed they knew something I didnt and kept the money. In 2008 (Jan or Feb) I think, my Mortgage payment went from just about 1200 to almost 1600 a month. I had trouble making the payments on time with the 300.00 a month jump which put me behind. I called them several times to make arrangements but was told they couldnt help me unless I was facing for closure (they had sent me pre-forclosure notices 2 or 3 times before I called them).
I finally sent them a payment they sent it back, saying they needed another one. I sent 2 they said they needed 3, and send the 2 back. I finally went to my local housing authority to try and save my home. They contacted taylor bean who agreed to take the payments I had. By then it was 3 which left me owing 1. (they kept making me further behind by refusing my payment) This left me paying a late charge every month that they refused payment. They also faxed over the forms for me to fill out to help me with loan modification, delayed payment etc, which I filled out and faxed back immediately. I waited and waited for them to contact me, they never did. I continued to make my payment Plus Late charge every month. My mom died the end of december 08 which left me with enough money to get current on my mortgage. That was february. In Late June early July, they finally contacted me.
I was pre-qualified for a lower rate. Unfortuately, they guy who called on behalf of TB&W didnt even have the correct figures for my loan amount, payment amount etc. He said he would get the correct info and send out the paperwork that night. He said my mortgage would be 5.5%. I received the paperwork the next day (he sent it overnight). I reviewed it, and sent it back unsigned. It did not contain any of the corrected mortgage info and was contradictory as to what my rate would be. On place said 5.5% another said 5.675%. I wrote a letter explaining the reason I didnt sign it, asked for an ammeneded/corrected loan paper be sent to me clearling outlinging all charges/fees (he said in our phone conversation that there would be none, but the paperwork clearly showed charges which absorbed my escrow for "FEES"), and exactly what my rate would be. The going rate at the time was 5%. I was already losing all the money I had already paid toward the principal and could not understand how they could asses me more fees.
I went to make my payment the other night and was unable to pay it online as I always did. I called them immediately and got the answering machine saying they were closed and their normal business hours were M-F 9a to 8p. This was at 5:25 Pm on Friday.
I have escrow with them and am now concerned about my loan. Will I as well as all other people who have loans with TB&W have the opportunity to receive a lower rate? What happens to our escrow since our mortgage company has filed chapter 11? Where do we go from here? Can we recoup our late fees because of their neglegence?

We financed our home through TBW last year and was in the middle of having our loan modified, was only days away from being done when we tried to fax information over, was refused. A few days later we found out about the closure. After some frustration, we contacted FHA and got the information we needed on Bank of America taking over the portfolio. We are very stressed though because we were supposed to not have a payment until Oct. For anyone needing verification, can go to the HUD.gov web site and there is a PDF with the address for the new payments to be sent.

This company gave no notice of shutting down it's operations, and when trying to access phone and online systems,they gave no indication of what was happening. There was no ability to talk to anyone, emails were not returned, phone system just hung up when you went through being on hold for hours on end. These are people's homes and this is completely unacceptable. Right now, I just want to send my mortgage payment out, and don't believe I should have to pay any kind of late penalty or have a late payment on my credit report, because of their horrendous manner of doing business. Customers should have recieved notice immediately of closure, and there should have been more organized system of where to send payments.

offered lower rate 6.25 to 5.00% so sent in the paperwork. shut down operations without notice, original loan in limbo. lost the chance to refinance at lower rate, did not seek other loan as TBW sent all the paperwork and said what my new rate would be. now RATES HAVE RISEN and it makes it impacticle to seek other loan cost 100-150.00 loss per month. don't know wee house payment goes. after 1 hr on hold the employee imediately apoligized foe not notice of company failure- felt sorry for her they just got their layoff notice by email

We had a loan with TB&W which has now been sold to Ocwen. We had modified our loan through Sparta servicing. When speaking to Ocwen today, the customer service rep. told me "We may honor your modification", until then "You are in forclosure". How can TB&W do this to their customers? Are we again in danger of losing our home? Who do we contact - no one will help at TB&W?

To this date, my check has not been cashed. This week I received an email from TBW stating my loan will be transfered to Cenlar. I called Cenlar and they stated I must wait for a welcome letter in the mail. In the past years many of my mortgages have been sold to other companies with no issues at all. But this time, it's hard to find out any information. Last- I am most worried about my payment and September 1st the realestate taxes, and Insurance are due. I will probably have to pay these out-of-pocket?

Is there a computer data breach at Taylor, Bean & Whitaker? Several people have reported fake phone calls from Bank of America requesting payment on TBW mortgages. How are these callers obtaining the information that someone has a TBW loan? I am really concerned since obtaining a loan requires providing credit reports, banks/credit card numbers, copies of drivers' licenses and other (hopefully) confidential info. Can someone investigate the possibility of a breach please.

Each month when calling to pay my mortgage, the line is busy for hours. Then they mark me late on my credit report. Also, trying to get an insurance issue straightened is ridiculous. They are worthless.

i recently purchase a loan from tbw and found out some devistating news from another lender that tbw has closed down due to fraud. me and my family is in suspense about our home. i tried calling tbw but answer. i recieved a letter stating that my mortgage is behind, but i have been making monthly payments. wondering are we going to be put out of our house. someone please help us

I was actaully able to get through to the company on Monday, Aug 16th. I was informed that they were in the process of moving all their loans to other companies and the new companies are expected to give everyone a 60-90 day grace period to catch up on the payments during the transfer. Now she did say that we should expect info in the mail and the companies should not be contacting us directly over the phone until after that time. Hope this info is helpful for those worried. Also there should not be any negative reporting to the credit agencies if you make your payments once you get the new info.

In May or June, 2008, we "locked in" a mortgage rate. We provided requested info in a timely fashion...time being of the essence in these matters. However, TBW continued to stall in granting its approval & when we were approved to close, it was..AT A HIGHER RATE (than locked in) which, of course, resulted in an additional mortgage mo. pmt of $100. We had no choice, I believed, except to close inasmuch as our construction lender was demanding payment (of the construciton loan).
Upon learning of TBW's difficulties, I called the Ocala office & was politely directed to where I should send my payments. It was a straightforward expeience (relief), quite unlike our initial contact with TBW which was a downright horror story. $1200 p/yr in required monthly payments until the mortgage is satisfied.

I received a call from a guy named Sam on 8/21/09, stating he was from Bank of America's collection agency calling to find out why I haven't paid my TBW mortgage. When I asked him why a collection is calling to collect when TBW went out of business and how did he get my information, he immediately told me to have a good day and hung up. Please be aware of people trying to act on behalf of BofA and get your payments sent to them. I just phoned BofA and spoke with their Customer Service, who indicated that they don't have the TBW records yet and wouldn't be charging fees, nor hiring a collection agency to collect the August payments.

At this point I was concerned. I know that I had to make this payment or I would loss my home. I tryed calling TBW and was on hold for 2 1/2 hours prior to a automative service coming over the phone stating they are experiencing techical problems and please try later, then they hung up. That day I went to my bank, took out a Cashier Check and sent my payment over night to TBW Cashering department. According to the mail tracker they received and signed for my payment. Since then I have called many times, still yet to talk to anyone, I have no clue whats going on with my laon, have read and heard many things that have me concerned.

2. Was told by TB&W that I would have to do an 80/20 on my new home since I already owned the other home. They said when it sold I could combine my first and second into one loan.
3. Sold my first home immediately-Called TB&W and was told that I couldn't combine my first and second until I had lived in my home for two years and built up equity. (At the time I was making over $40,000.00)
4. Tried to refinance a couple of different times over the next 2 years-with TB&W fees it would have saved me $20 a month, so it wasn't worth it.)
5. My place of employment moved to Phoenix; I could not relocate.
6. Out of work for 6 months-pulled out all of my retirement to pay mortgage on time-on unemployment and working on-call at the hospital.
7. Called TB&W to try and refinance and combine the 1st and 2nd-was told my income wasn't sufficient, and the value of my house had fallen to less than I owed on it.
8. Obama's Help for Homeowners was introduced.9. Called TB&W-no one ever answered the phone.
10. Called HUD-filled out modification application. Was told I had to be late on my payments one month to qualify.
11. Made my payments every month, but was late.
12. TB&W sent me a delinquincy letter on my first telling me they were the servicer of my loan and to apply for a refinance or modification. I did.
13. TB&W sent me a letter (same as above) on my 2nd. I filled out the application for the modification for that one as well.
14. Didn't feel my person at HUD knew what he was talking about/was referred to Renee C. She knew someone at TB&W. Since I could never get a real person, she emailed her friend and found out that my applications had been sent to Sparta Special Servicing.15. Wanted to make sure both loans had gone to Sparta-was told by TB&W that info for both loans was the same, and that the 2nd was being taken care of as well.
16. April 2009-was hired full-time at the hospital making $10 an hour less than I had when I bought my home. Had to take it as there was nothing else plus 300 applicants for every good job.17. Received approval from Sparta for modification. Put me on a 3-month trial period. Asked them if this included my 2nd-they replied that they didn't handle 2nds, but that TB&W would modify my 2nd. Made my first payment on my trial period to Sparta.
18. Called TB&W and sat on hold for hours at a time. Took 3 days off from work so I could sit at home on hold and not be fired. Was told the following: TB&W is not doing anything with 2nds; they would work on modifying my 2nd for a $2000.00 up front payment; TB&W was not the Servicer on my 2nd and that it was owned by 21st Mortgage (a company I had never heard of nor made payments to); that I was a liar and that no one at TB&W would have ever told me I could combine my first and seconds and that I should apologize to my neighbors for bringing down their home values (this was by Joe A in the Refinance Department-one of the numbers I was transfered to for some reason), etc., etc.
19. Started researching for complaints against TB&W and found where several states had won a lawsuit against TB&W (This was on The Mortgage Insider website). I went on to read the details and found an email for a Melissa Spata at the TB&W HQ in Ocala.
20. Sent Melissa an email detailing my situation, how I had been treated by TB&W, and a Press Release from the US Department of the Treasury regarding Obama's 4/28/09 initiative to help the Making Home Affordable Second Lien Program.
21. Immediately received a call from Ed Ll, a Director at the HQ who said he would have my case reviewed by the Loss Mitigation Department.
22. Received a call from Helen W in Loss Mitigation. She advised me that she had been in touch with 21st Mortgage, and that they had told her TB&W could do what they wanted with my 2nd. On July 28th, she sent me an email saying that she had "just received the authorization from the investor for my loan, and it would be approved the following Monday." On the phone she explained that it would either be relinquished or modified and that she would call me the minute she found out.
23. Never heard another word-no response to emails or phone messages. Went online to see that TB&W had been shut down.
24. Called Sparta-was told my loan was being transfered and to not send payment.
25. Called HUD and was told that Bank of America was taking over all the loans.
26. Called Bank of America and was told that was correct and was given an address to send payments for both my first and second loans, which I did.
27. Today I receive a letter from TB&W saying that my first has been transfered to Ocwen.
28. I also received a letter from 21st Mortgage (the ONLY letter I have ever received from them) saying they will be the new servicer of my loan (my 2nd)as of AUGUST 21, 2009!!
Was it legal for TB&W to tell me that my second was owned by 21st Mortgage and then to find out today that they were not?!
I am extremely upset. I called Ocwen and found out that I have to fill out the entire modification application and go through the whole process again on my first.
And this 21st Mortgage-they are not on Obama's approved list of modification servicers. There are numerous complaints against them on the internet-they apparently service loans on manufactured homes or trailers.
What am I supposed to do?

Same problems here. I have been worried for 2-3 months because of not being able to get through, no information, changing my monthly payment suddenly. I guess I will sit tight and see who picks up my mortgge. Very frustrating.

I've tried to get a hold of Taylor Bean & Whitaker for a week now to make my loan payment for August 2009, but have been unable to get a hold of anyone. The website will not let me log in and I when I call I just get an automated message stating their office is closed but I call during their operating hours. Has anyone else been able to get a hold of them?

We modified our loan with TB&W and our trial period end as of the end of August. Nobody has let us know what will happen and Daniela said she was told to continue normal business. Does anyone know how to get a hold of some higher people to get an answer? Our note is being sold to Ocwen Financial. Will they honor our modification? This is so scary for us we don't want to loose our home and have no where else to go. Daniela is with Sparta Servicing who TB&W hired to help with loan modifications.

I have statements showing escrow for insurance, State Farm still says, too bad, we're not waiting until the TBW is settled with Bank of America. I've been a customer of State Farm for 17 years. Insurance Commissioner of GA says file a complaint with the state. I have..today.

Taylor Bean and Whitaker is impossible to get through to and the line disconnects you once you enter in your information. This has been the worst experience I have dealt with since I owned a home. I have been trying for 2 weeks to make my August payment and now its considered late. What am I supposed to do! I have trouble every month with them!

I, too, have had the same experience with Taylor, Bean & Whitaker. I called the FHA National Service Center (since this was the feds that seized TBW). The gentleman I talked to told me that Bank of America would be handling my mortgage. He also gave me an address to send in my house payment and a telephone number to contact Bank of America. When I contacted BOA, they explained that they would be servicing my mortgage and they had not received anything from the feds yet. They promised I would be receiving info thru the mail. If not I can call back.
I hope this will be of some help to someone.

I noticed that my online mortgage payment had not been deducted from my account. I went to the website and there's a notice saying that Taylor Bean has not processed anyone's online payment. I've tried to call and email, and I can't get any help. I am worried about my credit report, and late fees. I don't want creditors to think that I cannot make my payments on time.

Do not know how to make my Sept. 09 paymenyt. Can't get in touch with anyone from Taylor Bean via phone nor email. How do I make a Payment? This could cause numerous damages to credit and future payments. HELP!!!!

I love how we received zero notice that Taylor Bean was going out of business. They have been hoarding my escrow account money for over one year now, after I have tried no less than 5 times for them to issue a refund. We purchased our home in August, 2008 at which time we were paying a higher tax rate that the old owners were paying (the old home value was significantly higher than purchase price). When the supplemental tax assessment was issued showing we were issued a refund, and providing a assessment estimate, we notified TBW and requested they adjust the impound account to the proper amount.
TBW refused to lower the monthly tax payments we were making, stating that we did not have an actual tax bill. Over the year that we've owned the property, I mailed them proof of refund from the tax collector (which obviously showed we had overpaid), along with two notices from the tax assesor showing the reduced value of our home (which stated that the upcoming tax bill would be based on that value). Despite that, they never even reduced the tax amount to be based off purchase price (another clue that we were overpaying). We have been paying over $120 per month EXTRA into the impound account and they refused to fix it and refund the money. I reported them to the HUD to say the least, and still have not received a refund and impound adjustment. Hopefully BOFA will be able to fix it for us, all we want is our money back!

I paid my August mortgage payment to Taylor, Bean and Whitaker on August 7, 2009 through an online withdrawal from my checking account, but even when I checked today there is no indication that the funds have been taken out of my checking account. I tried to access my mortgage loan on line at TBW but it was "restricted" and there was a message to e-mail them. I did (twice) but have received no response.
I had noluck with their customer service number but finally managed to get through to the automated line that said that my payment was credited on August 10th. My question is why hasn't it been taken out of my checking account. Today when I went to their website there was a notice to home mortgage customers saying that TBW were no longer handling Fannie or Ginnie Mae loans and they were unable to offer online payment option. What gives?

We always make our payments online since TBW lost our check last year and last month they claimed they did not receive our auto pay and charged us a late fee.This month they sent us an eamil saying payment was received but it has not cleared our bank and we can not access our account online saying we are restricted.We can not reach them and they do not respond to our emails.Where did our payment go? and what to do??

TB&W charged my escrow account for a lender-forced insurance policy for my condo even though we have a master policy. My account was charged in March 2009 for a policy that was effectice beginning 8/18/08. They took 7 months to charge my account. I never received any coorespondence from them stating that a proof of insurance was necessary, nor did I receive a copy of the policy that they took out for me. During this time period, my associaiton's master policy was in effect and valid. Once I found out waht happened I had the associations insurance agent fax them the proof's of insurance twice and I sent it also a number of times. Now that TB&W are no longer in business I am concerned about the deficit in my escrow account.

I got a notice from TBW that my mortgage payments are going up almost $600/month!!!! I called them yesterday and they said that their office hours were 9am to 8pm M-F, but it was only 5:30!
I emailed and got the first email bounced back, I emailed again today (August 18th) and got it bounced back due to a "full inbox". I also called today and got only a busy signal. How do I find out what is going on with my loan? Does Bank of America have it now? This is insane!

I went to the TBW online site to pay my mortgage. I went through the process and recieved a confirmation number. However, I noticed my August payment was not coming out of my checking account days after it was supposed to. I went to the TBW website to see if it showed a payment and to my surprise I couldn't even access my account. The site said "restricted access" and I tried to call for assistance. I tried their customer service line numerous times. All attempts met with a busy signal. I contacted my bank and the said the payment had not been processed. Obviously I am not the only one this has happened to. My concerns it what do I need to do next...do I need to get an attorney?

I have also been frustrated by my inability to make my mortgage payment to Taylor Bean and Whittaker. I just spoke to a Bank of America representative. Our loans will be transfered to B of A and all fees and late penalties will be waived. Our loan due dates are extended until we receive the proper paperwork form B of A. We can then pay our payment on-line.

No information can be gained on any levels of the standing of my home mortgage. Emails sent never responded, phone numbers are busy, can not contact anyone at the company.

I've read all the complaints and I'm stunned. Folks, The federal government shut TBW down. There isn't anyone left to update thier website or process the payments. The feds gave all that to Bank of America to service. The government put 4000 plus people out of work and gave BofA a REALLY big stimulas package.

I tried to make my August payment and was unable to get a response via phone or email. I tried to call TB&W for a week straight to no avail. I found today that the company went belly up and Bank of America has taken over their loans. Fortunately Bank of America was responsive and friendly and helped me out.

I am not at all surprised about the demise of TB&W. Shortly after purchasing our home, I called Taylor, Bean and Whitaker to advise them of errors made on our first billing statement. Well I waited on hold for almost 2 hours just to get a customer service rep on the phone who treated me like a dog. He made it seem as though it was our fault and he did not make the corrections.
My husband and I have never missed a payment, we have one late notice posted on our account and it was TB&W fault. They debited our checking account twice and refused to put the money back in our account. We had to take time off work just to go to the bank and explain the situation. Every bill we paid for the month, that check was no good. Thank God our bank thought of us as valued customers and reversed the charges.
About four months we received a letter from TB&W stating that our property taxes was based on the previous homeowners (elderly couple)and we owe escrow. Our mortgage increase 145.00, I called everyday for two weeks, just to once again get a customer service rep. who acted as though I screwed up her day.

Ok, so made a payment on the 7th auto draft from checking, just checked it has been posted to my loan the NICE lady I spoke to said it will be drafted within the next few days. My complaint is with all these complaints scaring people...Everybody keeps saying BOA is the one taking over the loans - not the case they are being distributed out among several business. People need to be PATIENT and call T&B during 9-5 and yes sit on the phone waiting and someone will help you and let you know who will have your loan and give you a telephone number for the new loan holder. Please bear in mind that they are working with only a 1/3(if that) of the work staff they use to have and it is not the fault of the employee you are talking to!

If you are a holder of a USDA farm loan,
BoA may not accept your loan, that is what ours is. Most of the loans being transferred are most likely FHA or conventional loans.

not had any communications from BoA or

As most others, I realized this morning that TBW had closed shop. I never had an escrow service with TBW. Looking through my statements, I see a payment to some unrelated-to-me insurance company from my account. That resulted in a negative escrow balance in my account. I never paid attention as my monthly payments were still the same. The last 2 months, TBW has suddenly started collecting escrow payments through the automatic payments from my bank. On the positive side, I found out that they had paid my homeowners insurance. But, this whole escrow setup was done without my approval or request.

My experience with TBW has been much the same as most others. However I have one question what happens to my escow account. This company has been a nightmare. They have not been paying my taxes, I have faxed and faxed, reqested confirmation of recieving my tax bills and get nothing but silence. Then they go out of business and I have no idea how to get this strightened out. I'm not too worried about the payments someone will buy the loan and I'll be notified how to pay but what did they do keep the money in my escow? What a nighmare, and why has nothing been on television or the internet about this supposidely the were so big why nothing on the news. I got suspicious and googled them or I still wouldn't know that they had closed. I'm contacting my congressman tomorrow and I have already lawyered up I am not taking this lying down.

I too as others, tried numerous times to make my August payment online (this was the only option we were given a few months ago when our loan went to them). I kept trying for several days and was still unsuccessful. I thought that maybe their system was incurring tech. difficulties so I tried to call the 888# but it constantly stayed busy. I could not find any other numbers to call. So I e-mailed them and yet to my suprise NO RESPONSE! After my husband got home from work this evening we got on the internet again and tried to pay again and the same thing could not log into our account! Then we started researching and found this site and found that we were not alone in this dilemma!!! And to top it all off this situation is bringing back bad memories from about a year ago. See last year we lost our home in a fire which if not was tragic enough the mortgage company that we were with made it even more horrifying! We paid our loan off in April by cashiers check and Fed-Exed it overnight with signature required. 2 days later I called to get comformation of reciept and they told me they had not received it but when I tracked it someone had signed for it. To make a long story short on my credit record they reported that my loan was paid in full but my May and June payments were over 30 days late (go figure)! It took us almost a year with uncounted phone calls and faxes and threats to get them to remove this from our credit! Now a few months after we have moved into our new home and trying to get settled this is bizarre situation is taking place with our new mortgage co. I pray that this is not the same scenario we have worked too long and hard to get our credit back in good standing and our family back on track!!! Are these people not human like us and realize what they are doing to their own kind and that the econony is already in a bind!

I think that TBW should have something on their web page letting their customers know what is going on. It is very disrespectful that they have just left us hanging after they were shut down. I have been in a panic because I haven't been able to get in contact with anyone to make my August payment.

I have consistanty made my mortgage payments to TB&W online. This month when I went to make my payment it denied me access to my account saying it is restricted and to call customer service. When I tried many, many times to call the number, and any other number I could find related to the company, I could not get through. It was either busy, once I waited on hold for a half hour and then was hung up on, or I got a recording saying they were closed, even though it was during their normal business hours.
After all this I decided to do a little investigating on the internet and to my surprise, found out TB&W is no longer in business. So, what happens to my mortgage account? Is this late payment going to mess up my credit i've worked so hard to build? It would have been nice if the company had let its customers know instead of leaving us hanging and clueless about what happened.

After not being able to make my monthly mortage payment online as usual I googled "what's happening with TBW?" That's when I found out the news! I later received a call from a friend who told me TW&W loans are being handled by Bank of America, he told me to call and get clarification. I did and was assisted by a very helpful reresenative who gave me a mailing address for my payment this month and said the late fee will be waived. She also said that a package will be mailed within the next week or two, but get the payment in asap.

On August 13th 2009 , I went to the TBW website to make my August payment. They said my payment was "restricted" and wouldn't let me make a payment. I tried to call their customer service # the same evening and got no answer (busy signal). I tried other comnputers the next day , no luck. I tried to call them many times on the 14th and 15th , again no luck. I guess now I talk to Bank Of America as many other posters on this site have done. I certainly hope they straighten this out ; my credit was sterling before this.

I have been trying to pay my August mortgage payment. I am in the same position as most who had a loan with TBW My escrow account is in a MESS! I have tried since March to get it straight to no avail! What do I do now? I called BOA and they said I need to overnight my payment in order to avoid any late fees now I am reading on here they are not charging late fees for the month of August?? Am I going to have to contact a lawyer to get my escrow straight?? Also I have made my payments on time every month even though my husband is currently unemployed. I filled out the harship papers backin April when his hours were cut and then updated when he was laid off in May and still know nothing except my payment has gone up due to an imaginary shortage in my escrow> WHAT DO I DO?????

I set up my account with TBW online for our mortgage payments to be automatically drafted every month. This will keep you current and no late fees or charges will be applicable. BoA is simply not reporting any late payments for these loans, but payments still need to be made!

I spoke to a BOA customer service and he was very friendly and very helpful.
He said we could mail our payment to BOA and place our Taylor Bean loan number on the check and that they will apply it to our account.

TB&W has notoriously had very poor customer servicing, including endless phone loops that virtually assure you don't talk to anyone at the company, hours of operation of the call center that make it virtually impossible for folkw working in other time zones to contact for assistance (BEING ROUTED through a 15 minute maze of telephone prompts is standard) and not being able to access your own account on line. I ran into a further problem when I incurred one late charge (by 2 days) and could not get the system to accept my payment of the late charge (May charge). Big question now is do we chance sending good money after bad and send the check in to the po box (not knowing whose pocket I'm lining, or wait for the lender to advise me. That sounds like the more prudent approach.

I also made an August payment online to TB&W that has not gone through yet. Was able to call Bank of America for transferred loan questions. They said the payment will not post until they have all the info from the TB&W transferred loans, but will eventually go through. They will be sending out welcome packets in 2 weeks with all the new loan and payment info. They also said there will be no late fees for the August payments.

TBW put me into forcloser. But they sold my Morage to BOA. so they cant go through with the forcloser our it would be vary ileagle for them to do so

I obtained my loan from TB&W in June of 2007. Shortly thereafter they raised my payment over $200 per month stating a deficieny in my escrow account, of which my realtor said there definitely shouldn't be one. TB&W said this increase in payment was supposed to last for one year in order to make up for the "so-called" escrow deficiency. Feeling like my hands were tied (I mean, they control my credit and my "house payment") the money was withdrawn from my account monthly.
But when 2008 came it was raised again to almost $250 per month. My escrow figures per month looked like this for 2008, AFTER a year of paying "above and beyond" to "settle the deficiency": Jan (-)$725; Feb (-)$479; Mar (-)285.35; Apr (+)$15.72; May (+)$262.91; June (-)$420; July (-)$173; Aug (+)74.60; Sept (-)$2,108; Oct (-)$1860; Nov (-)$1335; Dec (-)$702. There is no mathematical formula that makes these numbers make sense.
AND STILL in 2009 they said I have a deficiency to make up. I have documentation of calling them quarterly since the beginning, since I have not been satisfied with the answers. I have talked to my insurance company, the City Assessors Department, my title company, and my city tax department. I have submitted proof of what my actual charges and payments should be, but to no avail. I get no help by phone. And thus far, there hasn't been anyone NOT affiliated with this con-company who has been able to help me. I really need someone to audit my account because I feel like I have been ROBBED. Despite my efforts for resolution all I am left to do is ride the wave of uncertainty that they've created.

My e-billing link doesn't work, I can't pay, what happened to my previous papyment? No e-mail from them. No letter from them. The 1-888 # is always busy! I read where the Feds shut their doors.

I've had my mortgage with this company for three years, without any problems. I just want to pay my mortgage. I don't think the consumer(me) should be charged late fees or any adverse credit reports because they messed up.It is 8/17/09 and I have still not been notified where I can pay my mortgage.

I went on line to make my payments with tb&w it direct me to BOA. I was on hold for about 15mins after going through all of those promts. So when i spoke with a rep, he ask for my loan #, an the adress of the propety. After he put it in the information he said the there are no records of this loan, so I said are you sure,because when I called thei automatic line they directed me to BOA. So he said no records are on file for this loan an i asked him whom do I need to make my payments with, he told me to keep calling tb&w and the should take my payment or i could use the automatic services.
Why was my loan directed to BOA without me being notified. Now I am in a situation were i need to make a payment but I dont have no one to make it with. Why would I send my money to a company that i cant talk to, and i dont know who might end up with my money, an they say they have not received a payment. That woukd just put me further back in the hole. They could have at lease called or mail a letter so that the customers would know whats going on. It is bad enough that i tried to modif an they never return my call.
When i called them they said it is been process give them up to 1 week to process. So I called back that following week, an they said that they have no records of the information that i sent in. So i re-sent it, when i call back to check on it thats when I got directed to BOA. I still have not heard from them nor have i made a payment...whos gonna receive it..

Sent my August mortage payment on 8/10/09 along with several other bills. When I verified that they cleared my bank account, all had, except for the TBW check. I now see that TBW has gone under and my check remains uncashed. I have tried to contact them but to no avail. What happens now? I do not want to be responsible for a late payment and want to know where my next payment will go. There seems to be little information except for similar complaints on this matter.

I to have been effected by the TBW closure. They have sold all of the loans to Bank of America. I have contacted Bank of America about my loan and where to send the payment. They stated that it will be 4 to 6 weeks and we will receive a welcome package when our loans have been loaded into thier system, I asked them about the August payment and he said that I would not have one. I asked about late fees and he said that none would be assessed for the payments not being made.
You can call Bank of America to verify this information but this is what I was told.

After being "locked" out of my online account to view my e-statements AND attempting to contact this company by phone for two days to no avail, I finally learned today after threatening not to pay another dime, that Taylor, Bean & Whitaker is "CLOSING DOWN"!!!! I was told that our mortgages are being "transferred" to another company -- a company who now remains nameless -- and we will be notified by mail as to the particulars of the transfer. Although I have no faith in the individual's next statement, I was told that "this would be a smooth transition". I find this hard to believe given the fact that it took me two days and a threat to find out about the closure. Would it have been too much to ask that Taylor, Bean & Whitaker give its customers the courtesy of a letter informing us of their closure?

I have been trying tom pay my mortgage since the 2nd day of August and have been unsuccessful in loging into the site. Every month up to August has been a piece of cake. So I decided to call the payment in and that time I was told that my loean had been sold to Bank of America. I saw given 1-800 as the contact number to pay my mortgage. I called this number to pay my mortgage and was told that In needed an account number. I had no account number because I was not aware of this taking place.
I was told that Banl of America was in the process of notifing all the new accounts of this and the new account number for our loeans. Meanwhile I am more concrened about making my mortgage payment so that I am not late or have to pay any late fees. I was told by thr cust svc rep that tha tmonth of August payment was not going to be reported to the credit compays as late and to wait until I recieve my notice in the mail to make of the new account information to make my payment. I am concerned that this will in deed show on my credit report as a late mortgage payment and this is by no means any fault of mind. How long will this take place before I can pay my mortgage and rest knowing that my credit is still in good rating???

I'm glad to see I'm not the only one having issues with TBW! I've been trying to pay my mortgage since Friday and it says my account is restricted and to send an e-mail. I sent an e-mail but haven't received anything back. I've been calling TBW only to get a constant busy signal. I don't know what to do with my mortgage payment? What do we do? I can't afford late fees and don't think it's fair to get hit with them or with dings on my credit report when I've been trying in good faith to make my payment. How do we get guidance on this?

Well lets start with them telling me that i havent had home owners insurance for a year. Said they had no record of where to send payment, but on the statement that i recieve which are few and far between has my policy number and insurance company name, Go figure. Also my husband has been laid off so i call them tell them about it and ask if i can get my payment changed to a couple days later they said no you have to call FHA so i call them they tell me TB&W have to do that.
So i call back wait on hold for two hours tell them what FHA said told me there was nothing they could do. So i asked them to waive the late fee until my husband returned to work because the way and date his unemployment came in i would always be paying late fees. There comment was no is the all you needed. I said can i speak with your supervisor they said sorry this is as high as you can go and noone else will help you either.So i hang up very upset and excuses my lanuage ******* ***!!
So now my statements sometimes i get them sometimes i dont. And i can never get anyone on the phone anymore. And now i in the process of trying to find out what happened to August payment, which was mailed on August 3rd.

Taylor Bean & Whitaker was (is) the service provider of my loan - TBW and I had worked out a mod on my loan and I was to send in the first payment of the new amount on September 1, 2009. I called last Wednesday 8-12-09 to confirm that I was to send the funds certified and the new agreement that was sent to me by them with the payment or did they need that before the 9-1-09 payment - I was then told by a customer service rep. for TBW that they had sold my mortgage to Bank of America and not to send any money to them and wait to hear from Bank of America.
I was also told y the rep. that Bankof America did not have to agree to the same terms TBW and I had came to and it is possible I could lose my home but to wait until I got my Welcome package from Bank of America and she did not know whatelse to tell me. I know things are tough but it took me almost 5 months to get TBW to do anything for me and myloan - and now they sold the mortgage and I dont know what to do. I dont want to lose the house but I have been informed by both TBW and Bank of America not to send any money until I get my Welcome package from BOA. This is terrible TBW is playing with our homes the most important asset I have and I dont appreciate it. I would like to know if there is anything I can do to get a straight answer as to what is going to happen with my home.

I too have had the same frustrations as other TBW customers. I always made my payments online an noticed Aug. had not gone through my bank. WHen I call TBW, they said they payment had been applied and that I was to mail my payment for Sept 1 to Oscala. This was after being kept on hold for over 2 hrs. WHen I called a second time, I received nothing but a busy signal. I emailed them online with no response ans they suggested.
THeir website was no help and I was appalled to hear that my account was restricted. I googled TBW as well to find the same info as everyone else. To say I dont trust any of the info I have received would be an understatement. No one seems to know who my mortgage loan is going to and I am getting mixed information. Isn't there any protection for the consumer anymore? Don't we have any rights? I am terrified of how this is going to affect my credit score that I have worked so hard to achieve. Will they come after my home next? Should I be contacting a lawyer for legal advice? I know this is not over by a long shot and I need to know how to protect myself!

My husband and I were unable to make any payments online for our mortgage. We also were unable to get a phone call through to customer service. I checked the internet for any information regarding TBW customers and mortgage payments. There is an article in the St Petersburgh Times for TBW customers. It says that Bank of America will be sending out welcome letters to all TBW customers sometime within the next couple weeks.
In the meantime, customers can rest assured their will be no late fees charged. It also states that payments can be mailed to Bank of America (with the check including the TBW loan number). The article stated that if we as TBW customers decide to hold on to our monthly payments until we receive the Bank of America welcome letter, we can do so. We can do this because we are protected by regulation for 60 days.

On Saturday, August 15, I checked my checking account balance again and the mortgage still had not cleared. I tried to check the status with TBW but, was locked out of my account. After numerous attempts I could not contact the company.

I too began too notice how frustrating it is to try and contact ANYONE from TBW. Several months ago our mortgage payment jumped significantly due to what they called an "escrow shortage" in my account. And in the last couple months it has been quite difficult trying to make my monthly payment online (which I always do) This month (August 2009) I was able to get through to the screen to see what the payment due amount was and then the next screen told me I was restricted.
Naturally I immediately started dialing numbers to no avail. I was foolish AND I guess stubborn enough to stay on hold for an hour and a half. While on the phone I googled TBW to find out along with everyone hell that they've "locked" their doors. It truly amazes me how they've managed to send all of their customers onto this merry-go-round voice mail system. This by the way has happened even while they still occupied their offices. WHO IS GOING TO DO SOMETHING ABOUT THIS?
This is ludicrous that WE ALL must go through this and endure such stress and worriment until we receive the so-called "PACKET" from some other company that we did not sign an agreement with. I myself and scared to death because I too and quite concerned about credit score, etc. However I plan on putting our future mortgage payments along with Aug 2009's payment into an escrow account until the dust clears and we get some sort of proof that the NEXT company is legitimate and not going to send us on a wild goose chase or Eldibridge Hunting (for that matter) when we're trying to find out imformation on the most important aspect of our lives - OUR HOMES - that we work hard for. What is happening to this country?

We have never been last with our payments and now this month we are. We do not think there should be a late fee when ever some company picks up all this loans.I certainly will not mail a check at this point, because if I can't make a payment on-line or at least speak to someone I don't know where that payment will end up. I also have not received a statement from them in the last several months.

We have tried to pay our mortgage and have been refused by phone and online and we dont know who bought it out and so we expected the new company to let us know and be compliable with the expectations of the mortgage.

I cannot pay my mortgage. As of August my account comes up and this account is restricted. I've tried calling - to no avail - cannot reach anyone. I've tried emailing with no response. I've yet to make my August payment - I've always paid online since I got my mortage 4 years ago.
I finally searched online and found many others are having the same problem with TBW and don't know what to do.
Please add me to this list as I don't know what to do either.

I was invited by TBW to refinance from my 6 1/4% to around 5%. I worked with Lindsey M from TBW. She scheduled the appraisal which I paid out of pocket for and when the results came in at over 45% less than what I owed she stopped replying to all of my calls and emails. I disputed the appraisal and after obtaining a copy, the work was sloppy and inaccurate. The appraisal was riddled with errors and omissions.
I provided Lindsey a copy of the closing appraisal and asked for a refund or push the company for better quality. ALL and I mean ALL outgoing requests for a return call or email went unanswered. On top of this issue, I too am having difficulty making a payment for August. All emails and calls have been unanswered. Ginnie Mae President stated that the "transition will be seamless". It is NOT seamless and somebody needs to step in here!!!

I, too, have been unable to make payments with my seized mortgage company!! I was in the process, since January, of doing a loan modification and now nothing!! No returned emails, phone calls or fax!! I do not want this to tarnish our credit and incur a late payment. It would be nice, if they would at least put something on their website to assist the people who are currently affected by this!! I shutter to think what would happen if my house were to sell and I couldn't close out the mortgage!!

We have had our mortgage with TBW for 3 years. We always pay online. Their website makes it very difficult to make a payment. We have been trying to contact them by phone and have not been able to get a hold of anyone and when we try to pay online they say my loan is restricted. I don't want a late charge or a negative mark on my credit report.

I have repeatedly (more than 10 times since the opening of our loan)tried to contact Taylor Bean & Whittaker without success after holding for 45 minutes or more and when I have been successful I have not been able to rectify my problem. For example - our 1st payment was not recieved, unbeknownst to me, and I found out only by receiving the next month's bill with a late charge on it. I immediately called and explained the situation and was told that there was nothing they could do.
I have hence gone online to pay to avoid the situation and have had nothing but trouble just trying to pay what was owed. I would either have to apply for a new password and/or user name each time only to be "kicked off" and have to begin again. On our July statement, I paid on time only to be told that I was not adhering to the eastern time frame (that is not on the statement, it only says that it is due by a specific date)and was again charged a late fee. Now upon trying to pay August statement online, I was informed online and via telephone (using their listed phone numbers on their web site) that payments can not longer be accepted. I have been left no recourse to pay online to avoid mail difficulties and avoid a late reporting on my credit report.

I have been trying to pay my August months payment online and by phone. I couldn't get through. My account was Restricted. I was like, "What the heck". So then I finally googled why my account had been restricted and I came across this website. Everyone having the same problem. No notice of closure. I don't want to lose my home. I am putting my mortgage payment aside until I guess I get that so called "welcome packet" from Bank of America. I hope that I don't get no late fees or bad credit ratings. This is not fair...for anyone!

This month when I went to make my usual online payment I found that TBW will not accept it in that manner. After reading the complaints I am a little hesitant to send my payment in through the mail, only to find that it has not been applied to my loan. I am now owing a late fee and would likr to know who to contact about sending my payment as phone calls only give me a busy signal, all day, and trying to make a payment by phone only gets me the same results, besides it sounds to me I would be taking a big chance in getting the payment through the system in this way. What do I do?

Im so glad this site exsist and you all have posted your dealings with this Krazy Azz company now i have at least an idea whats going on No returned callls cant pay online cant speak to anyone concerning anything i hope they dont think they're gonna charge us these crazy late charges and fees just gonna stand by and see what happens at this point. thank you all for your postings God Bless

My mortgage was sold to TBW October 08. Thy have made making my mortgage payment a challenge each and every month. They don't cash my checks and then say I haven't made a payment. After being charged an $18 phone pay fee, late fee, and the fee my bank charges for canceling the original check, it adds up to an extra $60 a month! The last few months I have resorted to sending my payments with return receipt with certified mail so I have a proof they received my payment. I couldn't pay online - when I tried that, their website came back with the response that the account number was assigned to another person.
I have called many numbers without being able to speak with anyone, hung up the phone after being on hold for an operator for over an hour. I have complained to the bank who sold my loan to TBW and they said many people had also come in their office to do the same. I am glad to see the FHA come in and do something but I am worried about my payment that has arrived (I know by my tracking#) but not applied to my mortgage as of yet. It has been a terrible powerless feeling to have had them servicing such an important aspect of my life dealing with both my house and credit score.

In July of 2010 I attemped several times to contact TBW and explain to them that I was only able to make a partial mortgage payment that month due to cutbacks at work. Calling this company is a joke. You are on hold for at least an hour hearing how important you are and than being disconnected. Once I did get a hold of someone, I was told it was all or nothing. In the meantime, I tried through email to apply for the Homeowner Affordibility Act in which no one responded. After weeks, I received some paper work to fill out and send back to help with my mortgage. I proceeded to do this and set the paperwork in on August 6, 2010 through a fax. Again, no response. I am trying to save my home and this company will not even give you the time of day. What is going on? How can I speak with someone? Has this company shut down without notifying their clients? I need to know what is going on. How many other people have been put in this scary, horrible situation -wondering if they are going to have their homes. Hopefully, I can get a response from this.

We always pay our mortgage payment online and have never been late, so when I tried to pay this month, I got a message saying the loan is restricted. I tried calling but after going through the menus and being told the waiting time was several minutes, the system would knock me off. I tried 3 times and gave up. Tried again this morning and decided to email them like they request on the site. Then I googled them and found out that they're in trouble, in fact closed. I'm kind of freaking out, because what are we to do, the people who are doing all they can to keep a good credit rating and pay on time, despite the other sacrifices we're making because of this down economy! I don't want to lose my house because someone (yet again) has been dishonest in their dealings with the public!

Talked to Bank of America representative at 9:52 a.m. August 15th. Their advice regarding Taylor, Bean & Whitaker payments is to make payments through the mail to TBW. There will be no late charges assessed. Personally I am going to send a cashier's check by registered mail so that I have a record to whom, when and where it went.

I too have always made my payments via phone or internet. Like all of the others that tried 8/14/09 to make my monthly mortgage payment, I was unable to do so. After reading all of the complaints files similar to mine, I'm not sure waht to do next.

I have had my loan through Taylor, Bean and Whitaker for a couple of years, they bought out my previous mortgage company. I have been extremely frustrated over the past six months, four of the six I have not been able to get online to make a payment, one time I was charged a late fee. I have been trying for four days to make this month's payment online, they don't respond to e-mails and I can not get anyone to answer my calls. This has been much added stress, I am trying to pay my mortgage and there is no way to do so.

We have been trying to get our morgage refinanced since Dec. 2009. WE filled out 2 of the hardship pappers in Dec. We never got any answer. they never acknoledged they got them. We talked to another member of tb&w and he said he was going to check and see why no one ever got back with us. he saw on his computer where we had sent them in. In the meantime he sent another hardship form to fill out and fax to them. sowe did that too. we have not heard from him either.
so we called and our son called and e-mail the loan officer that had about3 months ago that it had already been approved that all she needed was the appraisal. then we could never get in touch with her. she had quit and we were not notified. so someone else called and they were told
to pick our loan and finishe it.So she called us and told us to get the appraisal done. We told her we did not have the money and could the appraiser put in one on our loan. she said they would not do that they had to have their monoey upfront. so she said it was supposed to be closed on July 9th 2009 and so we did pay the appraiser with July's payment.
Then the appraiser did us wrong. he come and done all his stuff here and when he went to compare prices of other homes supposeable like ours he went and gave the amount of 3 homes that has been already sold under forecloser for out price. One looks to be a single trailer and only one is near what ours is. so the loan offercier told her supervisor what he had done so she ordered a review of his appraisal and they , so we were told $150.00 to getthis done. It has been about 3 months and we stilll have not heard one word form anyone.

Taylor Bean and Whitaker is a crooked company, which has been allowed to bilk it's customers for years. I am not surprised that they were closed as a result of a "criminal investigation".

I was instructed to deposit a sum of $ 3000 dollars as escrow money to cover the repairs of the house, after I completed the repairs Taylor and Bean mail a check for $ 3000 dollars to "Global one solution instead of mailing it to me, because they claim the sold the mortage to City Group.
Since then Global one solution has been telling me they mail the check, they put the wrong address, it is lost it the mail, they are going to send me check.
Up until a moment ago, some office manger name Luoise, told me for the umteen time that they are putting the check in the mail

I am pleased to see that my last months payment was applied to my account. Spent several minutes on phone w/ BOA & lady did confirm all the info that would be 2/4 weeks to get a new packet w/ loan # & there would be no late fees .

I have had difficulty making my mortgage payment.
I initially tried to make my payment online (like I have done for almost a year now). It gave me an error message and I could not access my account. It said my loan is "currently restricted."
Then I tried to call the 888 number I have for TBW. I sat for a long time in a looping voicemail and then ended up being disconnected. This happened three times.So then I searched for other phone numbers for Taylor Bean. I could not reach anyone (all busy signals).
I saw a note that I could pay with Western Union so I set up an account with them. When I attempted to make a payment, though, TBW was not an option.
Then I tried to pay with Bill Matrix by phone and they gave me the first message that helped. They said that they no longer accept payment for TBW and that questions should be directed to the Housing and Urban Development. That number said it was out of the signal area.
Then I found a number for a local Florida TBW and their message said that TBW was no longer originating loans and then hung up on me.
I did send an email to the Taylor Bean Loan address as well.
I have been unable to reach anyone who can help me.

Trying to pay my mortgage via on line so that I would not fall late I could not get through. I do not have a computer at home so I have to do it at work. I tried to call and pay it over the phone but received a constant "please stay on the line" then after waiting on the line for over 1/2 hour a recording comes on and says there are to many calls on line call back later then it hangs up. It just so happens that it's due on the 16th of the month which happens to fall on Sunday but you cannot get through to anyone over the weekend.
This is the third time this has happened on line and I have been forced to pay the extra $18.00 to pay over the phone which I don't feel is fair when their online service is down. It's hard enough to scrape the the mortgage together these days let alone have to come up with another $18.00 because of their problems. How can this get resolved that Taylor Bean manage their online service better than they have and stop making customers have to pay extra.
I'm lucky I'm just making it without this company making it harder on me and other customers. I work very hard not to let any of my obligations slip into late charges. I don't want to be late and have that on my credit report. I've never been late.

First off we got a letter from TBW saying that our escrow was short over $500.00 and they were going to raise our payment to make up the difference or we could pay it in full. After reviewing my monthly statement I learned that they over paid our county taxes, I had to e-mail the bill from Thurston County Assessor's office to them along with the monthly statement that proved they over paid. When I called to find out the status they told me I had to get the money back from Thurston County. I said oh no I don't, I'm not the one that overpaid and I'm not going to do it. Thurston County gave us a break on our taxes for 2009 due to the flood that our house was in the river's way.
So after many e-mail's & phone calls to TBW they then sent me a letter saying our payment was going to be the same. Then the next day we get a letter with a refund so our escrow account was over. We are on the equity accelerator program and I got my bank statement & they took out more than what the payment was supposed to be. We didn't get a letter of explanantion of why, nothing changed. We are on a fixed interest rate so I don't know why they took more. I didn't even know these lawsuits were happening. It was because of my bank statement and the amount that was taken out.
I called TBW on 08/13/09 and asked for the accelerator programs phone number. I asked the lady that answered the phone (after I was on hold for an hour and a half) why my monthly payment went up. She told me she couldn't access any of my load information because it was transferred either today or tomorrow (I thought that was kind of strange that it was transferred in the future) to another company. She then told me my new mortgage company is Cenlar. Never heard of these folks.
I looked at my July statement and it shows my monthly payment the same as June's. Still don't know why it went up in July. But I will find out even if I have to hire a lawyer. I didn't even get a statement for August yet. I have also had problems with TBW right from the beginning which has been only 1 year now. Thank God we haven't gone into foreclosure YET! I'm afraid that it could happen to us. I just don't know what is going to happen. I have often wondered why sometimes I would look at the balance of my loan and wonder why it was going down. When you're on the accelerator program you're supposed to be paying it off sooner but the balance doesn't appear to be going down. I would like someone who knows what they are doing to audit my file with TBW.

June 2009 Went through Alpine Mtg. in Cinti, Oh. To refinance for a lesser rate. I paid 400.00 out of pocket for an appraisal. I was approved and had a closing. A day later the closing officer called and said she was very sorry but Feds had shut them down. Shouldn't someone at TB&W be held accountable for the 400.00?

I financed my mortage loan through Taylor Bean & Whitaker 2 years ago. When the rates dropped I started the process to refinance my condo in March of 2009 with Taylor Bean & Whitaker. I sent all the requested documents and was finally told that they were requesting an appraisal which I would have to pay for, which I did. The appraisal was completed and I was told everything was in order. After much not hearing from them for a couple of weeks - with much difficulty I finally was able to contact my loan officer, Lindsay Metzger and was told that I did not qualify.
If this is so, then surely I should have been told before spending approx. $375 for an appraisal.

Taylor Bean and Whitaker being the one holding my note on my home concerns me as I had a fire and they wrote to me and informed me I must sign and mail the insurance check to them. Can not get a name so I can regester and certify the mail so I know who gets it and were it's going

My problem with Taylor,Bean & Whitaker started when I noticed a jump on my monthly payment from 12/08 to 01/09 of $61.14. This payment continued until 07/09. I have been charged late fees that should not be there. Now from 07/09 to 08/09 my payment jumped $530.60. They are charging me for insurance when I already had sent them proof of insurance. Also they paid my taxes without my authorization. I spoke with a Jessica in the insurance department and they were suppose to be working on the problem. I also talked to a Debbie about my tax problem and she gave me a work order # and that I should be hearing from them in 3 days.
I decided to go ahead and try to pay online because I didn't want my payment to be late but I was restricted to get online. I had been trying to phone them but I would stay on hold for at least an hour each time I called. I finally came across a number and I was told that Taylor, Bean & Whitaker had been shut down by the government and that I would be receiving a letter from Bank of America whom I would be making my payments to without a late fee. Now I'm wondering what is going to happen to my monthly payment? Is it ever going to go back to what it initially was? Who is working on my work order?

I received a letter from TB&W earlier this year telling me that I possibly qualified for a new program which would lower my interest, thus lowering my monthly payment. So, I did the paper work and was approved. I was to sign the papers yesterday, August 12, 2009, with a closing company chosen by TB&W. I received a call, from the closing company, the last week in July setting up this meeting, then last Thursday, I received a call from the same closing company to say TB&W had cancelled their services. Like so many, I called TB&W and one and a half hours later hung up because it was obvious my call was not going to answered and I have to work for a living, in order to pay this mortgage. I am a single woman, just divorced 9 years ago. I was homeless for a year when I left a bad marriage--this house means so much to me!!! I am scared to death now that I won't be able to keep my HOME! I have no idea at this point who will get my mortgage and if this will change the terms of my loan making it impossible for me to make the payments. I have NEVER been late or missed a payment.
I am thoroughly disgusted with the "big money" people messing with the lives of people like me who go to work everyday and try to do the right thing. My 401k is shot from the thieves, now my mortgage is in jeopardy! The lawmakers in Washington,DC really need to take care of these thieves!

I got a house loan from Talor, Bean and Whitaker on March 20, 2009. At that time I made arrangements for direct withdrawals from my bank account so that my payment would always be in good time. In May, the payment was a few days slow coming out. I contacted the company by email, and than the payment showed up, but I have had a funny feeling ever since because the payment came out a couple days late both in June and July.
So, it's August 13, and the payment was to be drawn on August 5th, and still hasn't been taken care of. I have called the toll free number, and I believe it's off the hook. The company's other number yielded a series of instructions that circled me right back to where I started with the call. I now have no access to the web link the company gave me for my loan. It doesn't recognize my loan #, and when I attempted to register again, it wouldn't let me. I found the home page of TB&W on the internet, and tried to register so I could email someone, but though I filled out the form four times, it would keep saying something was done incorrectly. The last thing I did, was to lift a couple of addresses off that home page, and I've sent an email to them.

My name is Flora and I am speaking on behalf of my mother who does not speak English. My mother has been trying to modify her loan since January, 2009. Taylor Bean & Whitaker has been nothing but headaches and full of crap. When my mother try to call someone in customer service it will take her approximately two hours to get someone to speak to her in Spanish.
When she did got a hold of someone the rep was rude as hell! My mother explained to the guy that she was having trouble making her payments because her parents had passed away less then a year and she had to cover the funeral expenses. She also tried to explained that she had invested her money on a company that was declared fradulent by the FBI. She told him that she lost all her money. She asked if she can apply to modify her loan because she was having trouble making payments on the house.
That jerk basically told her that she either had to turn in her keys to the lender, try to do a short sale on the house or go for foreclosure. My mother was devasted and couldn't believe that he wasn't being courteous enough to offer her the package for her to apply for a modification. She then tried again the following day and was told by a woman that due to the overwhelming calls that they were receiving that someone will call her back the next day. Which it never happened. She then called and waited for an hour and a half when a man answered, she politely asked if she can have someone that speaks Spanish to assitst her. What he did next made my blood boil.
He took a deep breath told her something in English and SLAMMED the phone so hard that she got scared. She thought he had put her on hold but withing a few seconds a recording came up and said if she like to make a call please hang up or try again. My mother was devasted, angry, humiliated and scared. She said that Taylor Bean & Whitaker staff should be sued for disrespecting and abusing their customers. So, that's when I started making the calls. Of course, the waiting was horrible but nothing compare to when you wait for someone that speaks Spanish.
I finally, got someone that was very polite, her name is Amy. I told her what my mother had been through and she apologize. She then said that she was going to sent us the package for us to apply for a modification. Amy told us that once we mailed the package it would take 7 to 10 days for the lender to decide if she qualified. Once we received the package I had my mother called because she had a couple of questions she wanted to ask.
By now, she was afraid to call because of the horrible service she was getting by Taylor Bean. She got ahold of a lady name Rosemary. She was very polite and showed that she cared. My mother explained to her, her situation and told us that whenever we submit any paper work to the lender that we need to put our lender # and address on every document because sometimes paper work can be misplace or lost. So, we did just that and submitted our package. We waited and waited and waited and didn't hear from them over two weeks. I called and they said that they were still processing our package and that they will contact us if my mother had qualified. Three months passed by and nothing. I called and one of their representatives said that we had to submit our package again because what we had submitted wasn't current anymore. I was furious I asked why haven't they called to let us know or give us any update on our package. All he said was that he apologize and that we had to start all over.
We submitted our package again by this time it was April. We did exactly as they told us and within two weeks later we got a letter from Freddie Mac stating that they can help us stay in our home and make our payments more affordable. By this time I was confused. Why is Freddie Mac sending us a letter to help when Taylor Bean was helping or so called pretending to help. I called and sure enough they said that Taylor Bean can no longer help us because they were under staff and was being overwhelm with clients that wanted to modify their loans as well. I was so angry and asked Bill from Freddie Mac why Taylor Bean was giving us the run a round. He apologize and all he can say was that Freddie Mac was here to help. I then asked if we had to submit out package again and he said yes.
I then asked him what happened to the package that we had submitted. He took a deep breath and sounded sad of what he was about to say. He told me that Taylor Bean had shredded our paperwork that we had mailed. All I did was take a deep breath and try not to scream. I try not to show my anger and frustration in front of my mother so that she wouldn't worried. Bill told us that it would take up to 7 to 10 days for them to check and see if we qualify for the modification. We waited and waited and of course nothing happened. I called and they said it was still being reviewed.
By now its August and I happened to call Freddie Mac on August 11 and Catrice told me that our loan modification package was no longer being reviewed. I went crazy and asked why? She told me that Freddie Mac had sold our loan to someone else and if I wanted to know the new lender that I had to call back on August 12. I asked her why didn't we get any calls or letters to let us know we've been sold to another lender. She said its legal to sale peoples loans. I told her that I understood that part but why sale our loan now that it was in the process of being review. She couldn't answer and of course her tone of voice sounded like she didn't care and was rushing me to hand up. I told her I was going to call again tomorrow. I called August 12 and a guy by the name Tria answered and was quick to ask for my mother's loan number.
I gave it to him and he was quick to get fired up and started telling me that it showed in the system that I had called about the loan and that they can no longer help. He kept on talking until I was so disgusted by their service that I told him to SHUT UP.
I told him how dare he speaks to me in that tone of voice not knowing what I was calling for. I let him have it because I was just frustrated tired and disappointed with all of them. I then asked if he can give me the number to the new lender that took over my mother's loan and he said that even though Freddie Mac had sold the loan that they didn't have that information ready. I asked him if that is what the lenders do in order for them not to help the folks modify their loans, give them the run around or not even get one call so that we can lose our homes?
Of course, he didn't reply all he said was for me to call back on Friday, August 14 and that we should be getting a letter by mailed letting us know who are new lender is going to be. I'm very disappointed with Taylor Bean & Whitaker and Freddie Mac. My mother actually has hope that she can get her loan modify. I'm praying that we do. We don't want to lose our home. The physical damaged that resulted was my mother was humiliated, bullied, harassed and ended up with depression and stressed out. I was told to wait about 2 to 3 weeks for a BOA Welcome packet that will provide me with a new BOA account number. There is no need to send in the money this month RIGHT NOW, but if you owe August then set it aside and be sure you send it in with the new account number. There are so many loans coming into BOA that they say it will take about 2 to 3 weeks to get them entered properly and then get the welcome packets out.
If you were liable for August payment at Taylor Bean, then you will be liable for August payment at BOA.

I applied for loan modification with Taylor Bean on March 25, 2009 and received a letter dated March 31, acknowledging the receipt of our hardship packet and requesting additional information within 5 days of the receipt of the letter. I received the letter on April 6 and faxed all the requested information into Taylor Bean on April 9. I called to confirm receipt of my documents and was told that someone would get back to us once they received it.
I never heard back from them and called them back two days later to be told that our package was in the system for review and that it will take 8-12 weeks for it to be processed. I called back again a week later to inform them of our hardship and wanted to see if we could get immediate help as I had been out of work for over 2 months by now and was 2 payments behind. I was told to continue making whatever payments I could, I then sent in a payment for May, June and July of which two of the payments were applied to the back payments. I continued to call and was told that our modification request was in process and again it will take longer to get the modificaion request processed because of the numbers of requests received.
On August 1, 2009 we received a certified letter from TBW's attorneys that our house had been scheduled for foreclosure due to default. Needless to say I was shocked. My understanding was that we were being considered for modification or some type of help and relief. Instead I received foreclosure notice. I immediately called Sparta Servicing, the company listed on the foreclosure notice and explained the situation regarding our modification request and was told that they don't see a modification request from me in the system at all and since it had been over 90 days from the original request, I'd have to submit a new request.
At this point I was extremely concerned and afraid of losing my home, I did not want to waste time by submitting a new modification request. I asked them what the reinstatement amount was to get my loan reinstated and was told to send in a payment of $6656.36 to Taylor Bean and they will recall the mortgage. I called family members and a friend and arranged for the money to send into TBW. I then called TBW the next day to find out where to send the money to and to check if I needed to contact the attorney that had sent the foreclosure notice. I was then told by another Sparta representative that I need to send the money into the attorney's office and not directly to TBW. I was told to contact the attorney for the exact amount due.
I immediately called the attorney to see what the reinstatement amount would be and was told that they didn't have the exact amount and they would need to get that from TBW(Sparta). I was horrified. Sparta was saying the the attorney's office needs to give the reinstatement figures and the attorney's office was saying that Sparta will give the reinstatement figures and we would have to wait 3-5 days to get that. I waited 3 days and emailed the attorney's office and received a reply back to call with any questions. I then called them and left a voicemail for which I got a return call indicating that the 5 days were not up yet. Finally on August 10, I received and email from the attorney's office indicating that the reinstatement amount was $12,043.36. This included late fees, attorny costs and past due payments.
The amount given to me as past due was around $6600 and the reinstatement was almost double that. Thankfully we were able to come up with the money and went into the attorney's office on August 11 and paid the reinstatement and get the foreclosure sale cancelled. I have never dealt with a company such as TBW. Apparently they don't realize how they are playing with peoples' lives.
Just now discovering what is happening with them, I hope to God that our payment gets where it needs to be and our loan gets reinstated correctly. It was not my fault that I was laid off of work and lost my job, it was not my fault that I couldn't find another job immediately. I had thought that we would get some sort of relief through the loan modification program instead I got the biggest nightmare of my life.

By invitation from TBW we were invited under Obama's HASP program (as a reward for our excellent credit history) to apply for a refi at a reduced interest rate. We applaied on June 1, 2009 and received nofification of an interest rate lock. From that point everything became crazy and now it appears that all our efforts were in vain. Where is our application now?
A second problem is our escrow account. We are paying about $100 per month more than required and we have a large excess in our account. We were told this would be adjusted, but it never was. Who do we talk with to get our escrow account adjusted to the correct level? We have always paid our bills on time but we are getting no assistance unless we are a problem child. Is this the wave of the future under Obama?
