We hired MRS back in July 2009 to help us with get our house back. We have a signed contract with MRS (or their lawyer) for $3,600. This included $1,800 for a written proposal to our bank then the remainder would be considered earned once the bank agreed to the proposal. The money was paid and we did not hear anything until my wife called them in October. At that time, they had said that "They were working with the bank and all they had to do was to find the title". No other paperwork was sent to us once they received the funds.
In February, we received papers from the bank asking us to vacate the house. My wife immediately called MRS, trying to find out what the status was. It was then and only then that we found out, that they could not help us. We asked about a refund and the owner of the company was rude to my wife, stating that she should check the contract and that no refund would be given. I called back and talked to Sue, who ask me to fax a copy of the contract (that they should have had on file) to her so she could look at it. She made the statement that, yes, the contract states we are entitled to $1,800 back, and that they had us sign the wrong contract. (Our lawyer out here in NY also stated a refund is due.)
While I was doing this, I was talking to the bank who said they had only received two phone calls from MRS. No proposal had been delivered to them. I called Sue back and she said the contract was with the lawyer not MRS. (Who we had been calling and talking to.) We had a lawyer contact, the lawyer who said that she had not worked with MRS for over a year. We still have not received any money back and we are pursuing legal action against both the lawyer and MRS. We have contacted the California Attorney General and will also be contacting the California BAR. No refund has been given. No action had been performed on our behalf either.
