The lending agent at Benchmark lending coerced us to pull money out of my primary residence and use it as a down payment on another property. I was harassed by the lender constantly to not let the equity sit and go to waste. They insisted that money should be pulled from the primary home, that there was no chance of the market turning down. They were highly insistent that I should get another note, then the original note was sold from avelo to Litton, and the second note was sold to Countrywide. I am barely able to make these notes now, not to mention the property is worth 50%. I have repeatedly spoke with each company, and since I am not in arrears they don't want to work with me. In fact the responses have been down right rude, and it's painfully obvious they don't want to work with us.

My wife and I have both been working two jobs, our daughter is paying a serious price in not seeing her parents, and my medical condition is worsening by the day. My back is in bad shape and I have the medical records/bills to prove it. We are not quitters and are willing to work harder than most. Although we are not wealthy we are very, very hard working and willing to do what it takes, too bad our creditor aren't.

They're trying to put our house into forclosure...a house we've lived in for over 25 years. They didn't even notify us. We started getting calls from people because of the public record. They did not honor the modification agreement we had with Popular Bank prior to transfering our loan to them. The payments we make aren't reflected in any way - both online or in mailed statements. We call and get the run around. We are told different things by different representatives - all not honoring a word that is said. We make payments, and they get returned.

We've been making payments since October and not one is sbown on our statements, yet each statement shows the amount accumulating! We have Western Union receipts to show they are getting the money. On top of that they return our payment and then request a ridiculous amount in order to stop foreclosure. If I can't make a 4000 payment, what makes them think I can make a 19,000 one. It's companies like this that are making the economy go bad. Instead of helping and working with us, they're throwing us out.

The government is assisting these companies, and they're treating us, the consumers, like garbage. We're not going down that easily. I am contacting an attorney, as well as a class action one. I am also writing and contacting, city council members, state congressmen, HUD, media, and anyone else who will listen to us. Please, please, I beg of you to contact me. We are consumers with rights! My house was put on foreclosure with out any sort of notification.

2 year Adjusted Rate kicked in where we could not afford the new payment especially with a new born child. After Avelo Mortgage sold the loan to Litton, the problems began and never stopped. I tried to get a modification since the value of the home was less than what I purchased for. I also tried to get a short sale worked. I sent several email correspondence with no resolution. In contacting the customer service, [they] had different departments to go through depending on what problem was and what stage loan was in. Basically, had to start from the beginning once somebody else was in charge of [our] account. I realized that this process was not easy but I didn't think they would be rude and impossible. I ended up contacting different lawyers to work things out but they also had the same bad experience with Litton.

The end result was they don't care what happens to [our] home. We are all just numbers. I ended up gutting the property and taking everything. I hope they come looking for me but I know they won't since they don't care. The wonderful thing is bankruptcy allows you to wipeout the debt and start again so don't let these idiots ruin your life. There will be better days ahead. I had just heard from a broker that a person who had a bankruptcy recently qualified for another home loan since all the debts are gone and there income is decent. The banks are now looking at your debt to income ratio more than just the credit score. There is hope and why shouldn't there be. The economy rebounding depends on the majority. We are the majority.

i am behind on my mortgage and called litton to make a payment a payment and they refuse to however they work out a forbearance agreement and send it to me that have a 2100.00 atterney fee for them but do nat want to answer any calls from me or talk to me but said if i do not fax it back today .it will not be valid thanks

may cause proceed to foreclosure

I got behind in my payments in the spring of 2008. I made an overpayment to get caught up and they returned it because I hadn't worked out an arrangement with them. In order to stop foreclosure, I caught up on my payments with a check for 5,000. Of that, there is 671.66 unaccounted for. I repeatedly asked both the Litton representative and the Law office for a detailed listing of the legal and Litton charges I was being accessed. Never received it from either party. They then increased my payments from 682.84 to 1,027.48. I don't understand how any of this can be legal; it certainly is unethical. I got behind again and on Thursday received my double payment back and also received another notice for Sheriff's Sale. I called and left a message saying I wanted to pay and would he please call me. I called twice today (Saturday) and the main line just rings.

I can't afford the increased mortgage. I was totally embarrassed that my home was listed for Sheriff's Sale 3 weeks in a row even though I had already paid the 5,000. I had people calling to offer me money. It was heartwarming; but totally humiliating. And this was AFTER the Litton rep told me she would stop the foreclosure.
