My wife, Annie, were in need of a loan modification and we heard 1-800-FIX BANK on 94.7 FM radio. I dialed the number and the law office stated they can force the bank to work with consumers. They claim it is the law and since we were having problems paying the three mortgage payments we have on our home, we made an appointment to go see them. We met with Alex. He said he was the office manager and we explained our situation.
After speaking with Alex and explaining our situation, he said he could save our home and he needed $35,000 to save it. I explained to him that I did not have $35,000 and he said he would except $8,000 to start and I would have to make payment arrangements on the balance. He said he would have to file chapter 13 Bankruptcy to stall for time since I did not have the $35,000 and then he would convert it to chapter 11.
Alex explained to us about lien stripping under Chapter 11 Reorganization plan example [18:124] Prevailing market interest rate; [18:120] Combines claim Bifurcation with Cram down; [18:122] Present value of deferred payments must equal value of collateral, Alex gave us great hope and because of all the literature that he also gave us convinced us that he was legitimate.
We never met with a licensed attorney at his office. I paid a total of $19.000 to date and we recently found out that our home was foreclosed on the August 11,2010. I was at their office on August 12 because I was told I need to bring in more money for them to continue working on the file. I gave them a check for $5,000. On the August 12, I was not aware that my house had already been sold. 1-800 -fix bank proceeded to cash a post dated check I left at their office on the August 24 for $2,000.
I got a letter in the mail on August 26 stating that our home was sold at auction and I visited the Law Office the following day to ask what happened. Alex gave me numerous excuses and none of them made any sense since he was aware of my situation before he took and continued to take our money. The fee to file for Chapter 13 is approximately $275 this law office filed it electronically.
I visited the Bankruptcy court at both 700 s Flower downtown Los Angeles and 255 E Temple and I could not find any proof of Chapter 11 ever being filed on my behalf. We have lost a substantial amount of money and our home to this company and we would like to be compensated for our loss. Please feel free to call me if you need further information. Thank you.
