My mother is a victim of Alzheimers - I as her only child have full power of attorney to handle her affairs- All of her liquid assets were used up for her care and she now resides in a 24-hr care facility, which takes all her monthly social security income- Her investment properties are in foreclosure and GMAC Mortgage seems poised to just take her properties leaving her with absolutelty nothing- My husband and I have tried for the last 9 months to restructure the loans, with no principal reductions, but then will NOT work with us....their stalling has now got us to the foreclosure wire on two properties, which seems to be their goal! Take my 84 year mother's property rather than restructure the loans - I have left over a dozen messages for GMAC Mortgage over the last five days- NO call back! My mothers investment properties have enough rental income to take care of themselves and if 4% interest only/just 5-year loan restructures/with impounds could be obtained, they could be sold in the next 5 years as the real estate markets recover...allowing my mother's lifetime of work to account for something.

For people who are having problem with GMAC Mortgage, I suggest that each person do a google search on their state foreclosure help. Most states help people who are facing foreclosure from companies like GMAC. You should do this ASAP before the GMAC or any other mortgage company completes your foreclosure. If you have missed at least 2 payments to your mortgage company now is the time to react. I found my state of Kentucky to be very forceful with this company. I also had great results good luck to all.

I have been trying since August of last year for them too here my pleas for help, I am going to lose my home to foreclosure in june 0f 2009, I feel that with all the government help out there the lenders should be egar to help, but they wont even listen, please here my plea, I have ran out of options they wont even give me an answer, they just keep telling me that June 17th is a ways away and we have plenty of time. We have done everything in our power to make ends meet but unfortunately we have fallen short and would like [them] to consider working with us under the Making Home Affordable Guidelines that the government has put forward to modify our loan. Our number one goal is to keep our home and we would really appreciate the opportunity to do that. It is our full intention to pay what we owe. It has taken me over a year to find a good paying job that would be enough to start paying my obligations again. I am please asking again to work with us and help us keep our home. Our situation has gotten better because I am working full time again with a steady income. We feel that a loan modification would benefit us both. We would appreciate if [they] can work with us to lower or delinquent amount owed and or payment so we can keep our home and also afford to make amends with [GMAC]

It all started in Oct 2008 when my income was drasticly reduced. I call GMAC right away to try an extend the term of my loan to make it more affordable. They would not even hear of it because I was not behind. So of course I could not make the next months payment and called again. The collection agent I talked to stated "well, you should put the house on the market before we forclose on it". Nice way to help a loyal customer.

Sense then I have been calling weekly and faxing the information they requiered for a loan modification. Each month goes by and every time I send the information they need, they wait 30 days and say they need more info. Again I fax over the info they already told me they had recieved the month before.

Now in April 2009 I am 90 days behind and they want more info. I send all pay stubs and tax returns on April 2 2009 called the every day and finaly on Apirl 15 2009 they stated "we have all your requiered information and the process can take up to 30 days. 15 days later they send me a letter stating they need me to fax them tax returns and pay stubs again? At this point I believe they know my house is worth more than I owe and are just looking to foreclose and sell the property for a profit.

Now May and in forclosure, Thay are still not willing to help me refinace for a longer term. As I stated, I just need to refinace for a longer term to make it more affordable, I'm not looking for a bail out like there lender Freddie Mac. Just a lower monthly payment. I could go on and on, but You get the picture. Thanks alot.

We have an adjustable mortgage with GMAC, the mortgage is at the point to where we are unable to keep up payments, however we have contacted a mortgage company that has pre-approved us to refinance our loan however when we call GMAC, we are tranferred for agent to agent constantly and we are unable to get in touch to the person to ok the refinance. We are being told that GMAC will no release the loan to have is refinanced.

Currently our home has just gone into foreclosure but 1st option mortgage company had already preapproved us to refinance our mortgage in May 2008. All we want is to refinance our loan at a lower interest rate which GMAC will not agree to do.

my gmac mortgage was paid off in november of 1998, and was never discharged. tried to contact someone at gmac and got no help what so ever. i'm trying to refi. because of the lower intrest rates. what can i do?

I sent my paper work in to the loss mitigation Dept. and GMAC says they never received them. I sent them with a tracking number and the tracking number said they were received two days later. I have been taking all GMAC phone call and have told them my husband lost his job permanently with GM last week.

Have been a loyal customer to GMAC for my mortgage for 7 years without a late payment. In February of 2007 my home had a small fire in the attic, which was declared out by the fire department, only to re-kindle within 18 hrs - burning the entire second floor. The repairs took several months to complete and as a result I had to move my family into a new home. The property was listed on MLS immediately upon the completion of work and was on the market for 2 full years. At one point we even rented it out and regretted that after tenant paid only two mos, while staying over five and damaging the property upon his middle of the night move out. Through all of these tough times (24 mos +), we continued to pay GMAC - regardless of hardship. Costs added up and our sons college fund of over 35k was depleted.

I called GMAC to seek assistance, but was quickly sent of to the loan modification department. After sharing all of our personal information, including my new lower earned income (self-employed and living in Michigan), they told me that we did not make enough to have the payment lowered?? I asked about selling the home on a short sale, which was a last resort for us to consider. Already losing 40k of home improvements, 126k in mortgage payments, etc. (Never wanted this to happen) They told us to lower the price and contact them with any offers.

My agent with Coldwell Banker has had 4 offers to present GMAC and has not been able to get a return phone call. The only department he can even reach with any consistency is the loan modification department and they tell him that they do not know where my file is or who he can speak to about the matter. As of yesterday he called me to share that another offer has now been pulled from the table, as people do not have 2-3 weeks to wait for GMAC to respond on the offers. I am lost for words, have lost too many nights sleep, lost my sons college fund and am at whits end!

My wife and I are current on our new home and will never let it get behind, as it appears there is no system in place to ensure the working class a way to communicate with lending agencies to keep or sell their homes for that matter. Whats worse is hearing how much money has been given to banks like GMAC and their lack of interest in working with their clients. I too was a victim of the vacancy questions at the home in question. They were quick to call my insurance company to reach me about how to change my policy to reflect the home being unoccupied and pushing for a swift foreclosure on the 4th month of non-payment.

This should have never happened to us. My home was for sale before the economy took it biggest blows - 2 years ago the home was complete and ready to sell. The price point was over 200k originally, 175k 5.5 mos later after damage was repaired, 155k after another 2 mos and now it is listed at 130k. 10k less than owed and no response on any offers has been made by GMAC. Anyone out there disciplining fraudulent and wasteful spending of our tax dollars? If so, please email me - I will cry wolf.

In 45 years of doing business with companies I have never found one to be as screwed up as GMAC Mortgage. Their costumer service people are ill-informed, unprofessional, and God forbid you want to speak to the same person twice. When I was laid off from my job in November, my wife and I called GMAC to make them aware of the situation. The person we spoke with said, "Oh, you are calling way to early. You shouldn't call until you are 60 days behind. We have people 10 months behind that we haven't taken care of yet." We called back in January and the circus began. 1. We have gotten the same paperwork three different times on several occasions. 2. I got a call on a Wednesday in March telling me I would have a decision in 10 days. The next day I got a message saying I would have a decision in 5 days. I called to ask which was right and was told that neither was right and they had not even looked at my paperwork yet. 3. I filled out a set of documents for them and faxed it in on a Thursday. I called the same day to confirm that they had received the fax, which they said they did. One week later I got the same packet in the mail. When I called they said to ignore the mailing,as they already had the forms from me. The next week I got a letter telling me that if I didn't send in the paperwork they were going to cancel the modification request. Again I called and again they said to ignore the letter.

Two weeks ago I got a letter saying they needed an additional form filled out, which I did and faxed it back. I called the next day to confirm that they had gotten it and the woman I talked to said all my paperwork was not the correct forms and I would need to submit them again. After downloading all the forms and filling them out again I called to say I was sending them in. The gentleman I spoke with said that I didn't need to send in anything, my papers were already on file. He said the woman I spoke with earlier in the day didn't know how to read the screen correctly. The following Monday I got a letter saying that if I didn't send in the lat form they had asked for then the modification would be canceled. When I called in I was again told to ignore the letter, they already had the form. Yesterday I received a call saying that my request for modification was approved and they were going to lower my monthly payment by what figured out to be 8%. Since my wife and I lost 50% of our income when I was laid off, 8% percent wasn't going to help me as my payment would still be 70% of our income. When I called to ask about how they arrived at the modification amount, I was told, "We just dump all the numbers into the computer and it spits out a number."

They say they are using the Obama Plan and that's the best they could do. When I asked to speak to the person who put together the modification I was told that she was much to busy to speak to anyone. I feel sorry for anyone who has to deal with this company. Take your blood pressure medicine, you're going to need it! As for my wife and I, we are going to walk away from this mess and lease a house down the street for half of what the monthly payment on this place would be.

On 04/01/09, just before a Sheriff's sale was scheduled for my primary residence, I received the following letter from GMAC: As we have been informed the above-referenced property is vacant, we will be sending a representative to the property within seven days to rekey and winterize, if applicable. We are taking this action for the protection of our security under the terms of the Mortgage/Deed of Trust. If you are maintaining the property, please contact teh Collections Department and we will attempt to cancel the work order. Collections Department-Loan Servicing

Since I LIVE HERE, I called to cancel the work order, which the representative did right away and seemed eager to dismiss the issue and get off of the telephone. I told her, You know, I find it hard to believe that with SO MANY forclosures out there, that GMAC is sending people around to each of them to get informed about whether the property is vacant, and to rekey the property. This seems like more of an effort to avoid waiting the 6 months after forclosure to kick people out by having GMAC say the property wasn't occupied.

She said that, Yes, we send those letters out to everyone, and if they call in, we note that the property is occupied. So GMAC is putting hundreds of thousands of homeowners in a panic, as if they had nothing else to have anxiety about, by stressing them as to whether they have 7 days rather than 6 months to get out of their house after forclosure. And they do this because GMAC is too lazy, cheap, and greedy (sound like a familiar pattern? Like the one that got us into this mess?) to actually let the presumption be that the home is occupied, or to go check it out for themselves.

There was NO INFORMATION that would have suggested I was NOT LIVING HERE. GMAC was on a fishing expedition and was hoping to bypass the President's efforts and statutory timeframes by claiming they'd made an effort and found the home unoccupied due to a lack of a response. If that's not illegal, it should be. I recorded the conversation.
