I refinanced in August '07. I got a pay-off statement, and my new bank paid them off. We got a clear title. A month later I was contacted and told that they put 670.00 in my account from someone else's account the same day as they gave us the pay off. They later realized their mistake and demanded payment in 14 days --or else. I have talked to them, sent e-mails and asked for documentation, and it's the same story--they cant give it to me --it's confidential! Today I got a letter demanding payment by the 7th of March or it goes to their attorney. I WANT A DETAILED ACCOUNT OF THE TRANSACTION of money into and out of my account and where it came from etc. They say they cant--or wont. I do not think they are being fair or cooperative since it is their mistake 100%. Why should I be forced to come up with a lump sum?

I am stessed from repeated threats.

GMAC mortgage adjusted my escrow amount. I currently have a balance of 2559.39; at the end of the year the balance will be 9018.39. They do not pay my home owner's insurance, just property taxes. Last year my property taxes were 5962.78. Even with their projected increase in property tax and the 1000.00 cushion they require, I am still overpaying. I spoke with them several times regarding this; they say that there is nothing they can do. A week ago I went through the numbers with someone, and they said I was correct and would send me a refund check for 1200.00.

Today I called back and was told I was misinformed. They will not do anything. From reading the complaints on this consumer affairs website, seems like they are doing the same thing to many people. Economic damage: I, and probably several thousands of others, are overpaying into our escrow accounts. This money belongs to me, not them. I should be able to collect interest on this money, not them.

I refinanced my home in 2000. That was the worst mistake I ever made. The company was Fairbanks or they just serviced the loan, I went into default, signed a forbearance agreement, made every payment and still had to file a chapter 13 to try and fight the false outrageous amounts that they are claiming that I owe. I have consulted several lawyers as well as the Trustee and have gotten no where. If there is a lawyer that can help me please contact me

I am now in chapter 13, the amount I owed has tripled and yet they have more than 5000.00 that is sitting in escrow that I have overpaid. I can not get anyone to refinance the property, and the payments are outrageous.

If anyone has problems with GMAC it should be reported to Fannie Mae as well as HUD. I am providing everyone with the addresses. I filed this letter with Fannie Mae: "I am writing to inform you of the treatment that I have received from GMAC Mortgage. GMAC Mortgage has displayed poor customer service skills toward me, and GMAC does not seem to follow proper ethic or procedure when helping customers that have fallen behind in payments. My loan was due for September and October, when I called GMAC on November 8th to make 2 full payments. However GMAC refused to accept my payments. GMAC stated that I have been turned over to attorneys already-- AFTER ONLY TWO PAYMENTS! I tried to explain my situation, but all I got was negative feedback and very rude customer service reps. This situation all stemmed from bank error, yet GMAC has failed to comply with Fannie Mae rules. I have included with this letter all paper work that has been sent to GMAC, including the Bank letter regarding the payments and my conversation log with GMAC."

This loan should be modified in accordance with the lending laws. Fannie Mae has informed me that it is REQUIRED of the lender to at all cost work with the consumer. GMAC has failed to acknowledge that this was all the cause of a bank error and NOT the result of me simply neglecting to pay a debt. I feel this can be resolved without legal action. I am trying to refinance through Anderson Lending so I can Pay GMAC off. However, I have had no help from GMAC. Anderson Lending is pushing for me to file a lawsuit, but I really want to avoid that measure. I have all proof of conversations and a bank letter showing that this is all just a big misunderstanding. I am demanding that GMAC modify this loan and have my credit reflect that their is in fact no foreclosure so I can refinance and be done with GMAC. Anderson Lending has agreed to help my in any way possible including going to bat against GMAC to get this loan done. All documentation can be provided. It is now Jan 2008 and I feel I may getting somewhere because Fannie Mae contacted GMAC.

In December of 2007, I received an account analysis from GMAC. They stated that my mortgage payments would be going up approx 200.00/ month due to the fact that (not in so many words), they messed up my escrow. I had spoken to them prior to that, and they really are either uninformed or know that they can do what they want and get away with it. I was sick for the past year and unable to work. It was hard enough making payments before, but now I need to come up with 200.00 more a month. I believe GMAC is engaging in these practices to foreclose on homes. They never try to work with people, just belittle them when they call. In the past I have just said when I get on my feet, I will refinance and get away from them, but things are tough. How can a mortgage company raise a monthly payment close to 200.00 and that be o.k.? I could have gotten a better house for that.

When I bought my home, I purchased within my income. Now they are technically trying to put me out on the street, I believe, because they know I am under a doctor's care and they can hit me when I'm down. GMAC'S practices need some serious looking into. How can this be legal, let alone fair? Can someone please help us?
I have to pay for their error. I am still not working, and I may lose my home, causing more stress on me and more doctor's visits, and more time unable to work. It's cyclical.

I have had 2 very horrible experiences with GMAC. First I had a 1st Mortgage and 2nd Mortgage with GMAC; somehow I got my accounts messed up on my online banking and made my 1st mortgage payments to my 2nd mortgage. I didn't even know anything about it until I received a foreclosure notice on my front door. Needless to say, they would not transfer the money from my 2nd to my 1st. Cost me thousands to save my home. The second experience was that I was 15 days late on my mortgage payment, and they sent me into foreclosure and rejected my payment. Again it cost me thousands to save my home.

I ended up having to go bankrupt to get myself above the debt. I am a single Mom putting two kids through college, and no one at GMAC would even listen to me. I finally got one of my daughters through college and still have one in. I'm going to refinance my loan with a local bank. I don't trust GMAC Mortgage. They have ruined my credit!

Four Years! That's how long I have been trying to get ride of my PMI. The only number to that department is automated, you press 1 and they automatically send you the instructions. I believe I have at least 25 copies in my quest to ask questions. I have tried to pin down the customer service people as to how to talk to an individial and was either disconnected numerous times. I finally got someone who told me they don't talk on the phone in that department, there are no e-mail address or fax numbers for that department. If they are taking 130.00 per month from me I want to talk with someone.

I even called the local GMAC office to ask them, they only handle new loans, so I asked them if they can refer me to an acceptable apprasial office and she gave me the number of the company they (GMAC) use. I told this GMAC local office of the run around I have been getting for the past four years so they offered to help me, the young lady did a conference call with me trying to reach someone in the GMAC office for PMI, she enjoyed the expereince of being transfered around, then disconnected then sent to the automated number GMAC gives out as there PMI contact number which gives you one option which automatically send you yet another copy of there instructions. Finally I just went ahead got the apprasial and mailed it along with a letter explaining what I have gone through. The sent back my apprasial telling me they are unable to cancel the PMI at this time and checked the reason as "The appraisal is on the incorrect form." Give me a break! Their company refered me to these people. So I start again!

I started payments on this loan in September 2003 giving them 55 months of 130.00 costing me 7,150.00 cold hard cash. This is not to mention four years of aggravation, tons of time trying to reach someone. It should be against the law for anyone to take money from you and not allow any direct contact to speak with someone. Please help.

I wrote letters and called and notified GMAC mortgage that I was having issues with my job cut-back on my income, and a possible move to a country across sea. I told them I was not able to make my payments, and I asked them to help me with loan modification or anything else they had that would help. My information was passed around to several people, and and the last person who got the information was Mark who was very nasty and rude to me. He called me on Nov. 5th and said he did not have the information and to re-fax the information. I fax and faxed, and Janelle from the company told me he had not put the information in the system and that she could do nothing.

Mark called me on Nov.6,2007 and said he could do nothing, and my home would be foreclosed on at 10:00 am that day. He told me I did not have enough income. I told him about the conversation with Janelle, and he said it was too late. I have sent them paperwork on top of paperwork, and they still refuse to review my case and continue to give me the run around. I spoke with the foreclosure department who said they needed 15,000.00 to reinstate my loan all because of a mistake one of their representatives made. I have called all the consumer credit counselors, and everyone I have spoken with said GMAC's treatment is wrong. I have been in my home six years.

My house now is foreclosed, and I am in battle with them. I am trying to find an attorney to file a law suit against GMAC.

After I paid off the mortgage in full on 10/23/07, GMAC was to refund me an overpayment of 1,539.93 (from an automatic bank account withdrawal) which was done before I paid off the mortgage. Every time I call to find out what happened to the refund, they insist that the monies had been put back into my checking account on 11/05/07. This is not true.

I never got the refund, and after repeated calls to GMAC, I now know that no one (including supervisors) know where the refund is or want to help in any way. I have hit a virtual brick wall. My first call to GMAC was on 11/12/07. I do not have extra cash to throw away. This is my money and I want it back.

We have two mortgage loans with GMAC; they are making an easy profit off us considering we have NEVER paid late on any of our mortgages in the last 21 years. Basically what they have done is charge us for flood insurance that was not needed on one property. It's a long story, but I spent about 40 hours obtaining a Letter of Map Amendment from FEMA, then faxing all that information to Homecomings' (a GMAC Mortgage Company) insurance office. They have now tacked on the insurance's escrowed amount to our payment.

Then we got a new GMAC mortgage when we built a new home on our existing land, and they escrowed taxes for 2007 that were estimated for 2008! So far over the last three months we have overpaid this company about 4,000 because we don't want a negative record on our credit; but to try to talk to someone intelligent enough to fix the complicated problems they have caused us, is almost beyond what they are capable of in their customer service departments!

They are escrowing amounts that they don't need, so far to the tune of around 4,000.00. I have called and faxed and still can't get anyone to fix the complicated problems they have created on our two mortgage loans--all having to do with erroneous escrowed amounts.
