Their insurance department does not talk to their mortgage department, who does not talk to thier taxes department, who doesn't talk to their foreclosure department, who doesn't talk to their 'special promotions' department. I have loans with several mortgage companies. All are paid automatically, electronically, every month, without fail, on time, every time. All of them are simple matters, except for GMAC.

GMAC requests proof of insurance. This was provided six (Im not kidding, six!) times. Since they can't find the proof, they impound the mortgage payment. Eventually someone in insurance goes through their inbox and posts the proof. The insurance department takes a few weeks to let the mortgage side know. In the mean time, they start foreclosure proceedings. And, their automatic phone harrassment system goes into high gear. I get daily calls saying my loan is in default.

Then the letters start coming. I'm in default. Letters show that my credit rating is lowered for late payments. Then, just to sweeten the experience, I get phone calls asking if I want 'applicance protection' for only 60 a month. I have spent over 30 hours on phone calls, leaving messages, sending them thier own acknowledgemnts that I have never missed a payment, and that the property is insured. Still, they can't fix this. And, they're adding late fees.

Now get this: Their mortgage people refuse to do a conference call with their own insurance department. So, this batch of incompetents is destrying my credit, fining me, mis applying payments, and foreclosing. I encourage everyone to avoid GMAC at all costs.

I have a mortgage with GMAC and do not escrow for taxes and insurance. I received an 11,000 bill from GMAC in February of 2008 for hazard insurance because I did not have my own. I freaked out and called my insurance company to make sure I had the appropriate coverage and confirmed my policy was always current and in good standing. (Note: a competitive insurance premium is 2-3k)

I called GMAC and told them I have coverage and they instructed me to have my insurance company fax over the policy. The short version of this story is as follows. After faxing the policy to them 3 times and many phone calls between February and May they started applying my mortgage payments to the bogus force insurance plan while reporting me to the credit agencies 30,60, and 90 days late.

I learned this while arriving 1500 miles from my home on vacation only to have my credit card denied by the car rental company because AMEX reduced my credit limit by 70% as a result serious delinquency on my report. This credit card is paid off monthly and I planned on this as my source of payment for the whole trip. Only after threatening legal action via email would this get resolved. I just hope it stay resolved.

I was looking forward to paying off my 2nd Mortgage. My payments were taken from my bank electronically. They were due on the 1st of the month. On 7/24/08 I received a letter from ditech telling me they were cancelling my electronic payment immediately due to change in status of my account (my account had matured). I had ONE PAYMENT LEFT. The letter was dated 7/18/08, so I had to act fast. I knew if I mailed it, it might not make the 8/1/08 due date, so I called the 800 phone number to see if I could pay over the phone.

The recording said for payoff, press 2. I pressed 2. I was given the amount of 389.70. I opted to make the payment and was then told the amount would be 397.20, WHICH INCLUDED A 7.50 PROCESSING FEE. They just made an additional 7.50 off me because they stopped my monthly electronic payment and it was too close to the due date to mail my payment. What an EASY way for them to may addtional money from everyone they do this to.

So, I made my payment ONE WEEK EARLY on Friday, July 25, 2008. On Friday, August 1, 2008, I got a letter from ditech saying the payoff to your account was short and has a remaining balance of 19.56! What, their voice recording told me the amount was 389.70 NOT 409.26! I called the 800 number. After putting in my account number, the voice recording says congratulations on paying off your account! Ok, what's up? I called again to speak to customer service. She told me the additional 19.56 was for processing. What? Didn't I pay for that when I paid all the fees when I got my loan?

I asked to speak to a supervisor. Alma (the supervisor) was rude, spoke over me and then tried to tell me it was my fault because she couldn't see where I requested a pay off amount! I told her it was on the voice prompt (push #2 for payoff of your account). She said she would get back to me by Tuesday. I said NO, I WANT A CALL ON MONDAY 8/4/08 and hung up. I called the 800 number on Monday, August 4, 2008 and spoke to a very nice gentleman named Nathan. He said he understood my concerns and would get a letter out to me saying my payoff was NOT short and that the amount was for the recording fee. He said he would take my complaint to his immediate supervisor. I hope he wasn't lying.

I tried to send the 19.56 via FED EX (ditech said the additional funds must be collected immediately) but because the only supplied me with a PO Box in Iowa, I had to send it regular mail. VERY FRUSTRATING! I WILL NEVER DO BUSINESS WITH GMAC OR DITECH AGAIN. I WILL NOT RECOMMEND THEM TO ANYONE.

UNFORTUNATELY, I had my 1st Mortgage refinance through them. In 5 years when it is paid off, I will feel a great sense of relief and will make sure I send too much money to cover my butt and they will then have to go through the trouble of processing a refund to me! P.S. Two girls I work with are former ditech employees. When I met them last year and asked what they used to do, they said they used to do the loan processing for ditech. I told them I had a 1st and 2nd mortgage with ditech. Their response? Oh, we are so sorry to hear that.

I have excellent credit and have worked very hard to maintain that status. I hope their statement the payoff of your account was short and has a remaining balance of 19.56 does not reflect on my credit rating by saying I was late on my final payment! Again, my payment was NOT short. They are the ones that made the error!

I am calling to obtain information on a mortgage assumption for my client. I cannot get any answer as to what the policy and procedure is. All representatives state something different.

My client is divorced and has timeframes that need to be honored. We need consistent information in order to proceed.

GMAC Mortgage has refused to stop charging me PMI even though my principal balance has been paid down to 62%. I've been requesting they drop the PMI ever since I paid the principal down to 80%. According to the Homeowners' Protection Act, the mortgage company must automatically cancel the PMI once a borrower has their principal paid down to 78%. GMAC is in blatant violation of federal law. I'm now pursuing legal action and would like nothing more than to make this a class action suit.

After GMAC sent us a letter stating that we needed to add 514 to our escrow account then our payment would be adjusted to 1885.91 they sent us a payment coupon for 1972.39. I have called them at least 4 times. After holding twice for more than 1/2 hour I was cut off by the person that answered. One time the person did not understand english enough to know what I was talking about. Kept saying totally irrelevant things to me. Second live person said that it was all taken care of and there would be no problem. not. They have zero customer service!

Undue stress. Hours spent just trying to communicate with them. Now have mailed a letter to them stating the above problem. I would never do business with them again.

in 2003 gmac failed to pay my homeowners insurance form an escrow account on time the insurance was then canceled i was paying 428.00 per yr it then went to 1268.00 as of their neglect. gmac refused to resolve the problem even after sending me letters stating they are aware of the problem.then gmac sent me into forecloseure . i have counter sued them but my case was dismissed in 2007 because of a bad attorny with no guts. now their attorny gmac wants her fees from me and we are back in court on aug 7.

i have disclosure evidence from my case i will share showing that gmac committed fraud and they keep two sets of records. lost my home, can not buy a new one and cant even get a credit card, have had two mimi strokes because of the stress and iam on antidepressants

In 2006 I purchase a newly built house in Cypress for 413,000. I financed the house with a GMAC mortgage 30-year FIXED for 323,000 (.7%)and my deposit of 90,000. Soon after I purchase the house I discovered that I had Breast Cancer and had to go into treatment immediately, which means giving up m job with the Federal Government. I continued to pay my mortgage but when I saw that my money was beginning to be depleted, I notified GMAC of my medical situation several times without any response.

Since I was paying my own taxes, I also notified the Harris County Tax Office of my illness and entered into an agreement with them to make periodic payments of my taxes. During mid-summer of 2007 I began to have some late payments with my mortgage but quickly paid the fees, accordingly.

In October 2007, I received a letter from GMAC stating that I owed them 34,000 for taxes, they claimed, they paid to Harris County on my behalf. When I contacted Harris County, they denied it. They stated that GMAC did in fact paid just a bit above 9,000 for my 2006 taxes, which were the only taxes I owed. I tried several times (telephone & in writing) to contact GMAC about the claims of 34,000 in taxes, to no avail.

I contacted HUD who informed me to send a Hardship Letter to GMAC and I would be sure to receive a response. I did just that I received FEDEX letter from GMAC Houston Office stating that they wanted to help me. When I contacted the signor, Christy, she informed me that GMAC had paid the County 31,000 in taxes for your property taxes. I reminder her that I owed for only 11 months in 2006. She agreed that she learnt that I had an agreement wit the County but wanted to help me if I would provide her with a copy of my sale agreement with Coldwell Banker Realty (I had put the house up for sale at that time) and sign over the title to us. I refused and she told me that they would foreclose on my house.

Soon after that I received letters, on a daily basis, from GMAC stating that my mortgage beginning in Feb 2008 would be 6200/month. I tried to re-finance my mortgage with another company and learned from my Credit Report that GMAC had informed the Credit Bureaus that my mortgage was 6204/month for 360 months. This means that they had assessed my debt to them for my house that's worth only about 500,000 to 2,233,440. I , to date continued to make my original monthly payment of 2,309.45/month to GMAC and in fact has already paid August 2008 mortgage.

I have contacted GMAC CEO, Dave A several times, in writing, about making the necessary proper assessment of the 8,000+ that GMAC has already paid in taxes so I can re-imburse the company. To date I have not received any response but instead I am being harassed by GMAC Bill collectors, and Ms. R on a daily, hour-by-hour basis and was told on various occasions that if you do not pay up we will have you arrested,and you need our permission to retain an attorney.

I am unable to re-finance my house, apply for DSL and any other basic convenience because of my credit Score which is below 400 because my account is showing that I owe GMAC more than 33,000 for mortgage to GMAC, since March 2007. When I sent my cancelled checks and Bank Statement (as proof of payments) to all 3 Credit Bureaus, I received a letter from TransUnion stating that they could not accept my documentation because the company (GMAC) has confirmed that my monthly payments are 6204/month; that would mean I live in the Hearst Mansion or Buckingham Palace at that price.

Basically, GMAC is controlling and damaging my life. In the final analysis what they want is to take my new house because they know I am a single woman and do not have the funds to fight them legally. I am going through so much mental anxiety over the entire situation because I know what they are trying to do is wear me down and take my house because I have so much equity in the house. I would appreciate any assistance you can give even if you have to publish this situation in your paper.

Economic Damages - I am unable to live my life as I am unable to obtain any type of needed resources because of my Credit Report. Further, I am unable to get back into the federal government job, after spending 14 years in the federal government, because of my bad credit report caused by GMAC. Physical Damages - I am an emotional wreck because of this situation. I am experiencing Mental Anguish, loosing sleep, feel disgraced, anxiety, nervousness, and have developed rashes all over my body and have to be seeing a doctor as a result of the GMAC situation.

I sold my house Dec 2005. GMAC reported to all 3 credit agencies that I was late in Jan 2006. Obviously this is impossible. The people who bought my house were financed through GMAC, so there should not have been any confusion. I disputed this and all three agencies verified it as true. Next, I got copies of legal documents and faxed them over to GMAC. They removed the error from my report...but then they added another error dating back to 2005. They said I was late in August 2005. I have a bank statement that says otherwise. I believe they did it on purpose and I would love to have a lawsuit filed.

I was denied a refinancing loan through Sovereign Bank. I have had to spend countless hours researching/acquiring documentation to prove that their claims are false.

GMAC failed to pay our insurance then placed us with their own insurer at many times the price giving our escrow account a negative balance. Despite sending multiple copies of proof that we were insured they are still refusing to correct our escrow account. When we call we get shuffled from one department to the next sometimes being sent back to the first office we contacted. We have never missed one payment or even been late but they are threatening us with foreclosure because they keep putting most of what we send them toward our escrow account instead of toward our principal and interest

This is also affecting our credit rating. We have had our interest rate increased on our credit cards because we are behind on our GMAC payments Besides the financial damage that this mess has caused, it is causing great mental and emotion stress to both my wife and me. We have contacted a lawyer to try to get this cleared up. We are looking for witnesses who have had similar experiences.
