EMC/Chase Mortgage is a fraudulent company. I have been dealing with them for over 3 1/2 years trying to get a modification only to learn that they are predatory lenders. I hired an agency to do a forensic audit on my mortgage, and they have found them to be in several violations. They also found that MERS is a party in my mortgage. Which means that they may not even have proof of owning my mortgage. Lol.

I advise anyone who is dealing with a predatory lender to have a "forensic audit" done of their mortgage right away. I also have to thank God for helping me through this process.

We are waiting all these years to receive the low percent rate after the economy put properties lower in value. Thanks in advance. The rent is high without lower percent rates.

They don't deserve a rating. I was an EMC customer and it has taken me 3 hours to make my mortgage payment this month. I'm to the point where I don't care whether you get this money or not. But if it's a hassle next month, I just won't make it.

We are working with the loan modification since 2009 because we are struggling very much in our budget. Our monthly payment was $1,123.00, and now, EMC approved a trial in the amount of $1,461.78. We were astonished as the payment is even more. Now, we have hardship added to our emotional distress. We humbly request that you consider our expressed difficulties, and help us to keep our home.

I filed a complaint with the FTC recently and found info that in CA there was a class action suit against EMC Mortgage/Chase about EMC not allowing the consumer to modify the loan/loans with them as well as the same thing with Chase, not giving the proper docs. from the consumer to the proper dept and hiking up interest, late fees and calling the consumer at work and leaving vm and other stuff.

After I read some of this suit and also talked with atty. office in CA, I hoped I could find someone here in GA to help me.

I purchased my house in 10/05 and I did a two loan deal with an arm loan in 5 fives either I would need to ref. or try to pay whatever it would change to. Since the falling out of the housing industry my original loan was bought about 2 yrs after having it by EMC Mortgage and Chase bought them shortly thereafter.

My house is in Jasper, GA and I've had it for sale for over 2 years and no buyers. In August 2009 my financial situation was going downhill and I decided to try and modify the loans with EMC. I figured since Chase mortgage was in Atlanta area it would be easier to file the papers there. EMC corp. is Lewisville, TX. I talked with a loan officer and he had me fax all my forms to him. I tried falling up with him afterwards and only talked with him once again October 2009 he wanted a little more info from me so I faxed him the stuff. I tried calling many times after that to check on the status but never talked with again so then I tried the Corp. location and was told they had no idea and gave some story about if I had gave them the modified loan info then I would have be given a figure over the phone first to see if I qualify and I paid that figure for a couple of months then my mod. would proceed. I told them they were idiots and resent my papers to their location (12/09) and also gave them my realtor's info. Mr. Lee has been talking with the realtor and they sent me a short sale form to fill out and I Fedex back to them but I have since never been given my mod. loans approved. I receive harassing calls that I don't answer because I quit dealing with them back in April 2010 because they are so stupid. I have copies of everything that has been sent and also everything they send me. My second loan was recently sent to collection agency but have yet to contact them. Also I've received what my new payments should be since the arm loan/interest changed 5 years is up now. Also, they recently sent me info about how they can help me if I modify my loan which really ticks me off because I've done that twice in the past year.

I've now been sent papers that my house is in foreclosure even though I have a contract w/ EMC stating that I am allowed a short sale and my realtor also signed and sent EMC Mortgage. It is to be fore closured on 2/1/2011 and was sent again modification loan forms to fill out again.

The Class Action in CA specifically states Unlawful, Unfair and Deceptive Business Practices, Breach of Contract, Unjust Enrichment, Fraud, and Violating Consumer Legal Remedies.

My name is David. I live at **, Torrance, CA 90501. My family and I have been living in the area for 20 years. With the crisis economy we have suffered loss of income, causing a tremendous hardship and we became late on our mortgage payment. On 05/08/2009, I tried to contact EMC Mortgage Company for assistance; after several attempts they requested I fax documentation and I complied. I have been in constant communication with EMC and faxing documents. I was instructed by the modification department I would be place in the Making Home Affordable program; they never did.

Furthermore, I believe they transferred my loan to Ever Home Mortgage Company. I continue to fax document and call Ever and this is what I was advice to do and I have not received any positive result. I want to file a complaint against EMC and Ever Home Company for their process and fraudulently handling the loan modification. They lied to the homeowner by leading me to believe I was eligible for the Making Home Affordable program and would be placed on a trail payment to be followed by the permanent modification; instead, they are in the process of evicting me.

I request an investigation for the practices and procedure of EMC and Ever Home. Additionally, they are not in compliance with the guidelines of the Making Home Affordable program they sign. After they received the bail out money from the government and this is our tax money they got from us. I demand EMC and Ever Home take responsibility for what they have put my family through. We are emotionally distressed. My children are in constant fear of being evicted out into the street.

I request they modify my loan under the Making Home Affordable program as they had instructed since 2009. I am asking for your assistance.

After falling behind on our ARM mortgage payments and being denied a loan modification twice, we fell into foreclosure. The first denial was because we did not send the required paperwork but we sent all that was requested. The second denial was because the first denial made us ineligible, even though we were told we were eligible and we paid $67 to have all the required documentation faxed from a UPS store.

In October, on multiple occasions by multiple people, we were told that if we paid $13000 by October 31, 2010, the loan would be reinstated. We were given bank wire instructions which we verified multiple times. We borrowed the money against our retirement and wired it from our bank on October 26, 2010. We were told it would be received on October 27. We began calling on October 27 and were told the money was not received.

Since October 27, we have been trying to get the money credited to our account. We have spoken to dozens of people at EMC, Chase and our bank. We have talked to EMC several times a week. Each time, we have to explain the situation all over again and are told it will be looked into. We have been told that we never should have wired the money as that was the wrong way to get payments to them, even though we were told by several people to do this and were given the wire instructions by all of them.

I called again on November 29 ,only to be told that the money was sent back to our bank because it was not the 'right amount' to reinstate. Because they never credited my account, the amount due to reinstate has risen to $18000. I tried to explain that had they credited my account by October 31 as I was told they would, the loan would have been reinstated already, more attorney fees and costs would not have been incurred. They agreed to postpone the foreclosure by 30 days while the $13000 is located. It was not placed back in my account, but they still insist we owe $18000 to reinstate the loan.

In an attempt to escalate this, I have called their customer advocate, who transferred me to their 800 customer service number, who as usual could not help me. I called their customer complaints department two weeks ago. The voice mail said they would return the call within 24 hours. They never called. I did talk to one person in collections who tried to help me. He was the one who managed to get approval to have the foreclosure delayed but he has no authority to resolve this matter.

We don't have the additional money they are demanding as we borrowed the maximum allowed against our retirement. There is a possibility we could go on a repayment plan but we don't have much extra money, so they may not approve it. Had they credited our account when they should have, it would not be necessary. We do not have money to go to an attorney. As it stands, we will likely lose our house because of EMC's ineptitude or dishonesty, or both.

I have filed a complaint with the BBB. This company has an F rating. I also filed a complaint with the Texas Attorney General and the FTC. I called the Texas Department of Savings and Mortgage Lending and got instructions to file a complaint through them. None of these will save our house, but I want these people held accountable. Please do something about them, so they can't do this to others. I truly believe these people are nothing short of evil.

I just want to empathize with the so many others on here who are getting nowhere dealing with EMC on loan modifications and other challenges. I too have been going through a process for close to 2 years. It began with applying for a modification, which I was denied but before it was denied it took several months for any communication.

Further, I had to re-send the same paperwork in multiple times. They lost it, sent it to the wrong department, even sent me to claims when I wasn't behind on payments. So, alas I was denied. They encouraged me to apply for a mod again, so I did and still several months later, nothing. Still repeatedly sent docs over and over again while receiving harassing calls from other departments about missed payments because they do not seem to communicate between departments or on your electronic file. Frustrating. Finally, I had a foreclosure note on my house with an auction date. With no help in site, I contacted a friend who suggested I try doing a short sale which is a whole 'nother intrusive, degrading process in itself.

After being given the runaround for a loan modification (by the way, I too, was told to not pay my mortgage while waiting for the loan modification, and in consequence my credit was ruined. Also, 50 percent of the people told me I qualified for the loan modification and 50 percent did not), I decided after 7 months to short sale my property. After finding a buyer, having all paperwork completed, the title was in the process to fund a few days ago. The deadline for the property to close on Friday November 12 (mind you, it was initially supposed to close on the 15th). Due to the holiday, the money to fund was going to arrive a day late, and my agent requested an extension to Monday morning.

The negotiator flat out refused and for no reason is now set to foreclose on my property. Now tell me, what would it have taken for this man to extend the closing to one more day? My agent, the buyer's agent and all people involved in this process do not know why he is refusing. Is he going to get more money from the insurance that covers the company during foreclosure? How is this helping the consumer? Is it possible that they can get away with this? What rights do I have as a consumer? I will go into foreclosure for no valid reason.

Our issues started June 2008 when we first started to apply for a loan modification. We were first were turned down and told that is common and to reapply.

We had several attempts and were told why would we help you when there have not been missed house payments. We explained the adjustable loan was really hurting us and we're having a hard time just feeding our family. We finally had to hire a lawyer; the first law office could not accomplish anything with EMC so we had to seek another one(Flahive Law Corporation 2365 Iron Point Rd Folsom, CA 95630).

EMC has given everyone the runaround by losing paper work, transferring my loan to a third party company, asking for new paper work as they wanted the information on their letterhead, refusing to talk to my lawyer, and even though a third party authorization was signed. They basically pulled out all the tricks in the book to avoid doing a loan modification. Finally in December 2009, things became too difficult and we had to file bankruptcy. The bankruptcy was completed. During this time, EMC sent our account to a third party company Moss ******** and this was when the problem actually got worse. Moss ******** never completed the loan modification as I was told they would do. They lost all paper work submitted and then tossed us back to EMC; this is when EMC made a coding error to refuse house payments we submitted. This is horrible as this is currently coded as missed payments.

Our house payments are paid electronically and we never received any denials but the payments kept coming back. I kept on contacting EMC asking what was going on and no one could find the answer. Then a lady name Luda called me a liar and started yelling at me and harassing me. I finally had to hang up the phone. (This call happened on 1/13/10). Then on 1/25/10, a representative named Larry found the problem; the system was coded in error to reject payments. He said this was EMC's fault and had it corrected.

Because of EMC's error, we missed several house payments that they refused to adjust late payments on and they kept stating it did not matter since we would qualify for a loan modification, but again this would be another lie. I finally had to file a complaint with the Attorney General of Texas (7/9/10)and for this reason my loan modification process had to start over again now with the executive office handling the case. I would finally be assigned a Relationship Manager named Don ****; this would only last a few weeks and I would then be reassigned to a Kurt ***. Contacts were limited and response time will go days when I was told calls/emails would be answered in 24-48 hours. This rarely happened.

I asked for questions to be answered and this never happened. An example would be I have had four BPO (broker price opinion) done in a five month period (6/9, 7/9, 9/24 and 11/2). I asked why were so many being done? I never got a response. I am currently still waiting for a response from Kurt as it has been seven days and counting. The last response form Kurt was they were waiting for the investor ,Wells Fargo, to sign off on the loan modification. He also could not find out any details and now I know why the offer was horrible.

Our current house payment is $2,395.21 (includes tax/insurance/etc.). On 11/4, we finally received a FedEx letter making a loan modification offer of $2,628.27. Are you kidding me? How is this a loan modification as the payment is even more? And there in no mention of a decrease on the interest rate or if the adjustable mortgage will be removed. The $2,628.27 payment is not even a confirmed payment but an estimated payment and could be higher. I am insulted by this offer and have waited 2 years for this.

How can they call this helping me out and how do they have the nerve to say it is not negotiable and that I should just short sell my house then wait a few years and buy another? This was said by employee Bill *****. I cannot believe they allow their employees to offer this horrible advice that I did not even ask for. We want to keep our house and would like to work with EMC on a reasonable offer and not something where we are set up to fail. How is this acceptable by the government standards? I have detailed information on calls and emails; I can also provide dates, names, and times if requested. I appreciate any help you can offer with this company which has been purchased by JP Morgan Chase.

I started the loan modification process nearly two years ago. I have been sending and faxing the same documents over and over. Three times they have denied the loan modification n for the same document, the 4506T. The document is sent blank and I am to complete it and fax or send it back. I did so and in fact, I went to the IRS, who subsequently help me complete the document and then the IRS verified the record of non-filing (social security and pension not taxable) and mailed the verified form to EMC.

I verified with EMC receipt of the actual document from IRS and was told, everything is in. Then on October 5th I was told that again the document was not correct and that they actually want item #6-record of account instead of item #7. Item six doesn't even apply.

I am frustrated and very upset that for one check mark, I was denied. Worse than that is the fact that there are eight possible choices and EMC does not tell me what they want. They have proof from IRS of non-filing, so asking for a transcript of what? I have no idea and they will not help me. EMC insists that since the loan modification program is cancelled again that I need to start over (again) and then they will answer my questions? This is a travesty and it is obvious to me that EMC is not interested in helping consumers through the Obama Loan Modification Program.

I had gotten laid off after 10 years when the company closed. We only had my husband's job as income; we hung on making all payments for 1 yr using up checking and all savings before notifying them because I thought I'd get a job and wouldn't have to change my loan. So after all money was gone, we called EMC, explained the situation, did all the paperwork. Then for several months, they kept stalling us, losing paperwork, making us do things over several times. We kept callling so one would tell us anything. We were given the name of person handling our account, left hundreds of emails and phone calls. Not once would this person contact us.

Then we were given another name. It was the same routine and no responses. Then one of their own people said to stop paying then they will help you. So we did; she said within thirty days the loan would be done. I cried. I said I don't want our credit hurt. She said you will have to hurt your credit to get loan done and keep house, so we did. But the thirty days went into 5 months and it's still not done. We used the money to pay other bills to keep everything else current knowing this would be done.

Guess what ,1 yr passed and nothing. Then they said, "No, you have to pay all the money back, then we will help you." We borrowed the money from family and paid them up to date. Then, they said no, "sorry we can't help you." We got an attorney and was advised to file bankruptcy.

EMC ruined our lives, and my 800 credit score, I worked my entire life to have. I have never paid anything late, never. I hate them, horrible people. The people in collections are the rudest people I have ever dealt with in my life and I've been in customer service since I was 15 years old. Now, I have a 2-bed ap.tI had to get rid of almost everything I own to fit in my little apt and some animals. I hate these people. Karma, what goes around will come around. God will get them some day. Now I have nothing, no job, no home, less animals, terrible health.

Let me start out by saying if you're reading this, it means they have done the same things to you and just give you the run-around and ** up credit. We as a group need to come together with lawyer to file against them. If we let this continue, they're going to take our homes from us. My son and I have filled out the application for modification. We first did the application in December of 2009. Here it is November 2010. Before this point we have been knocked around by EMC .We finally received a document that we entered into a trail payment agreement that will start in November of 2010. I called in August because I received a letter that it will start in November. So I called and they said you don't have to pay until November.

October rolls in and they sent a non-payment alert to the credit bureau. I called about this and I still got the run around. So today, November 1, 2010, I tried to make a payment and like always they connect me to one department to the next. I called back they said the system is down. I called back later and they said that because my account is in trail modification, I can't pay over the phone. They said I can use the Western Union Speed Pay. I called the Western Speed Pay and it will not let me make the payment on the trail payment agreement amount. I never received any documents stating the way it should be paid. Let's join together to stop this mortgage company. My credit is destroyed and they still say I owe over $7,000 when they told me not to pay September and October's mortgage.

Since the beginning of October 2010 I have been trying to get a payment history and accounting of how those payments were applied. The first time I received history that was missing payments from February 2006 to September 2008. The second time they sent the history, those months are there but they do not account for the following.

In December of 2006, I received a "Repayment Agreement" stating I owed $10,896.93. My loan balance at that time was $91,734.93. I made the down payment per the "Repayment Agreement" of $1,603.83. The agreement states that if I make the down payment and subsequent payments, my loan would be up to date in January 2008. I made payments from January 2007 through May 2007 totaling $6263.62. This amount plus the down payment of $1,603.89 total to $7,867.45. In April 2007, I received a new note that says the balance is $100,890.16. I started making payments against the new balance in June 2007.

My question is: What happened to the $7867.45 I paid in the repayment agreement between December 2006 and May 2007? I believe that the new loan balance was in error or that my payments were not properly applied. I asked EMC to send an explanation of where the $7867.45 went. There is no explanation on the previously received loan payment history. They hung up on me. During the call, I was transferred 6 times and hung up on twice. I have documents supporting the payments (bank statements and wire receipts). My credit score is destroyed. Attempting to talk to some one at EMC who can answer my questions is taking a lot of time away from work. I am stressed and worried all the time because of trying to get an honest accounting.

In February 2009, my husband, Mark **, was laid off from his employment. We were already struggling financially.

In July 2009, I spoke to, EMC Mortgage customer service, Patricia about a modification on our mortgage. She give me three dates, for three months, the fifteenth of July 2009, fifteenth of August 2009 and fifteenth of September 2009 to pay monthly amount of $881.48. We paid our payments each month and in October 2009, I called EMC and spoke with Ann. She said our modification was approved and not to make any payments at this time and to check back in 2-4 weeks.

I called on 10-31-09, and talked to Travis and he told me, don't send a payment now and to call back in a week. I talked to Lachanda on 11-3-09 and she said we were approved for a modification. I called on November 7, 2009 and was told to contact Rebecca **, our negotiator, but I could never get in contact with her. I called on 11-16-2009, I talked to Dawn. She said our modification was approved and give me a phone number for Michael **. I called and was not able to get in touch with him.

I called on 11-19-09 and talked to Valerie, she give me negotiator dept, talked to Sabrina and phone disconnected. I called back and talked to Dawn and she said we were approved for modification but couldn't tell me anything else. I called 11-30-09 and was on hold for over an hour, had to hang up. I called 12-1-09 and spoke to Eljon. He give me a name, Narissa, as our negotiator. He said he would have her call me, I didn't receive her call.

I called back on 12-2-09 and talked to Eljon again and he said Tamera was our negotiator. I called on 12-4-09 and was on hold for a half hour. I called back on 12-8-09 and was told we were approved and our negotiator was Narissa. I called on 12-11-09 and talked to Sandra, was transferred to modification dept. couldn't tell me anything. I called on 12-14-09 and talked to Rinalda and was told we were approved and no changes. I called on 12-24-09 and talked to Emanuel and was told don't make any payments now, they are still making corrections.

I called on 12-29-09 and talked to Daniel, he give me phone number for Narissa and said to call her. I could not get in touch with her, I called back and talked to Susan and she said we were approved, payment due 2-1-10 and she would email to underwriting, send no payment now. I called on 1-7-10 to Narissa ** our negotiator and as usual I got the same old machine message.

I called 1-12-10 to Narissa and to another name given to me, a supervisor, Joe **, and as always, received answering machine messages. I never received any call backs ever. I called EMC on 1-12-10 and was told they would contact our negotiator, that was all they could do. I called 0n 1-19-10 and talked to Natashia and was told she would look over our file and call me back. On 1-21-10 I called and spoke to Natashia and she said she would call be back in a half hour at work today. Natashia called me back on my phone and left message on 2-1-10. Needed to talk to negotiator. Called several times during end of January and into February to talk to Narissa **, but I never was able to talk to her and she never returned my calls.

Called on 2-10-10 to EMC and was told to continue payments, still waiting on approval. I talked with negotiator finally in March 2010, and she said corrections were being made on modification. She said a program maybe we could do for five years paying only interest, but never called back. I called back in end of March and was given another negotiator. She also said corrections were being made on our modification. I called again and she said the same thing.

She told me later that we were not approved for this modification, that we had been all along told we were approved for, that it was just waiting for corrections. I called on 4-19-10 and talked to Kelly and she said negotiator or supervisor would call me back. I received no call as usual. I called 4-21-10 and talked to Karen at Chase and she said she could see approvals in our file. I called 4-23-10 and talked to Alene and was transferred to another dept that told me to resubmit for in house modification. I resubmitted thru fax my documents on 4-26-10.

I called on 6-1-10 and talked to Jamie, she said check with underwriting for review and check every 2 weeks, will receive call if can help. continue payments, same amount. I called 6-8-10, no approvals listed in file. I called on 6-15-10 and talked to Susan and she said to submit new information, and that we were not in foreclosure and we would get another modification packet in 15 days, if not to call back.

I called 7-19-10 and was told to send tax return and light bill and call back tomorrow. I called on 7-20-10 they received my papers. I called 7-30-10 and talked to Stacy and she said to call back in a few weeks, still in review. On 8-12-10, I sent notice of my hours changing to 40 hours week at work. I had to resubmit more documents thru fax on 8-17-10. I called on 8-21-10 and talked to Colette and she requested I resubmit our pay stubs for June, July and August and said our documents would expire October 1.

I faxed all documents requested on 8-23-10. I had to resubmit more documents on 8-25-10. I talked to Maricila on 9-2-10 and she said I had to resubmit, for the third time, our tax papers. I faxed them on 9-3-10. I called on 9-13-10 and was told the information was sent to underwriting. On 9-28-10, I had to fax our tax papers again. On 10-6-10, a letter was mailed to us stating that our request for federal Home Affordable Modification Program or any EMC modification programs were denied. We could either bring our account current or we have two options, short sale or deed-in-lieu of foreclosure. We want to keep our home, we build it ourselves with a few other families from the ground up. We pray that God will bless us and allow us to remain in our home.

I have tried to work with EMC Mortgage on a loan modification since June 2009. I followed all the instructions, called to make sure everything was received and complete, and have continually been passed from one person to another.

I lost my job in June 2009, and was told I was in a trial modification on four occasions, only to then be told I am not being modified. I am also in a 2010 flooded subdivision. I have a permanent job. Someone took a payment from me last month, yet this month I was told I could not remit a payment. I was given the telephone number of the underwriter. He changed his voice mail three times, finally with no greeting at all, and never returned my telephone call.

I was told that I was accepted to a loan modification in June 2010, and subsequently received a letter from Chase, saying I was not approved. I completed everything on time, yet was always told paperwork was missing. This has gone on for the last 15 months. I call every month and speak to a different person. EMC has no record of my follow up phone calls, my trial mod payments, or my employment.

When I ask to speak to the person in charge of my account, he/she is never available. I left numerous messages; I called my underwriter; I have mailed three letters to EMC, and reported this to Consumer Affairs. I believe these actions are fraudulent and must stop. EMC is not working with hard working people who are trying to modify mortgages.

This company has no idea what their telephone representatives are telling homeowners. The stories change each time I call. There are federal programs available, for hard working citizens, and those who experienced the flooding, yet no one is working with me. There are erroneous statements in EMC records. Each time I am provided with the wrong information, and the wrong information is in my loan record as well. I am an employed, tax paying citizen. This is an unfair business practice, and should be stopped.

Bottom line is 24 months trying to get a loan modification just to put what was behind on the back end of the loan. During this time, we got many different stories from many different people. Then receive a letter with foreclosure sale date! We then call again and they put it on hold for 30 days "trying to get the modification done". Well, 2 days before, there would have been nothing they could do but take our home we get the option of paying almost $16000.

Well, we managed to do that. Its been almost a month and EMC has still not applied the $16000 to the account and our payment for this month is now past due because they will not accept it as the they have not disbursed the $16000 to catch up the loan. Bottom line, they are not helpful and obliviously don't even help when you catch up the money!

My name is Mrs. Sandra ** and I'm a tax-paying citizen of Gwinnett County, GA. I have a rental property located in Lawrenceville, GA 30043. My mortgage payment was behind by two-months and my mortgage company (EverHome Mortgage Corp.), assured me that they could workout a Loan Modification. I forwarded my mortgage company three-checks, but the mortgage company denied receiving the checks. Then, the mortgage company returns my three-checks to me, uncashed, on Oct. 1, 2010.

My tenant calls to notify me that a note was tacked on the door, by Austin Broker's (404-545-6185/Sheriff), requesting that all occupants evacuate the premises within 48hrs or one-week, with a move out incentive of $300.00. While I was waiting for a response, from my mortgage company, on the status of my loan modification, my mortgage company, swiftly/illegally foreclosed and sold my home, in a public auction on Oct. 5, 2010.

Again, I'd really appreciate if someone could look into the illegal wrongdoings of the EverHome Mortgage Corporation. Thanks!

For the past couple of years I have been trying to get a modification from EMC/Chase. In 2008 I was told that all of the info had been deleted and I needed to resubmit everything. I did. Several months went by and I kept calling. No one knew what was taking so long. I was given Priscilla **'s #. She never answered or responded to a voice message.

I got a possible foreclosure notice. Alarmed I called EMC. No. I was still under modification review but I was not eligible for the President's modification but I am now under EMC review. I submitted forms again (2009). All the while they had me paying $465 but it was not being applied to my loan. It was being put in suspense until the next month $465 arrives and made a whole payment. Meanwhile, charges are accruing and this arrearage is not being put to the end of the loan. It is being reported as delinquent 9 months and paying as agreed. Now, I have received two notices saying that I have 32 days from the date of the letters to pay the arrearages. One letter dated September 16, I received on the 20th, and the other one is dated September 20, 2010 and I received it on the 25th.

I called and said I'd received the notice that foreclosure was possibly going to proceed against my home. The girl said, oh, that's because your modification was denied on the 14th due to insufficient income. I responded by saying, it would have been nice if someone had kept me abreast. Not one time did I ever speak with Priscilla **. I heard snickering in the background and she said, well ma'am you can always apply for modification again, just go to the website and download fax them to us. I retrieved the forms but have not submitted them. Frustrated, I went online, inquired about refinance and modification from other sources.

Several Law groups called and wanted $2500 or more in a lump sum or partial $1400 now $1400 later. One of the guys said it sounded as if EMC was stringing me along while knowing that they have no intention of modifying my loan and meanwhile, I am getting further behind because they aren't putting the arrearage to the end of the loan. When they tire of this, they will pounce and demand all or nothing. I sure hope he is wrong. I didn't not sign with either group because EMC advised that I was still under review at that time. The guy, Anthony apparently erred when stating that I was no longer under review in June 2010.

But now this September enlightenment has me talking with The Franklin Law Group (1-800-930-1172, ext 115), Franklin Law Group, The Grand Corporate Center, 7975 NW 154th Street, Suite 230, Miami Lakes, Fl 33016, 305-512-9400 Office, 800-931-8581 E-Fax, www.franklin.law.com. I am somewhat skeptical of them. I sent them the notice from EMC concerning the deadlines. Tre Ratliff goes, hmm so you may have to go to court hah? And I say, What!, and he says Oh no never mind, never mind, don't worry about a thing. I completed all of the forms, I could not find my 08/09 returns. I have my W2's and I signed the 4506T. He says oh they (EMC) will want the real thing not just bits of it and that is all that the 4506T will provide.

I said this is all I had to do the 1st few times with them. He had me call to request from the IRS a copy of my 08/09 forms. He says this is all he is waiting for. He didn't want to submit it incomplete. I understand that. However, I believe I have 30 days to get them in from the date they were denied, 9/14, which will be 10/13 or 14. I haven't gotten the IRS returns yet. I am hoping he is aware of these dates because 32 days from 9/20 is 10/21 or 10/22 and 32 days from 9/16 is 10/17 or 10/18.

He says the On Demand letter was sent to EMC, so they are aware that they will be representing me and told me not to send payments during this process. He also said for me not to contact EMC but I am wary about the foreclosure and the Franklin Law Group being legit and know what they are doing. Friday 10/8 Tre call and says my retainer had returned from the bank. I said that was not possible because there has been no attempt made to withdraw on my account. He calls back later and says it's no biggie, he thinks the accounting girl doesn't know what she is talking about because he asked her to show him the return notice from the bank and she could not produce it.

They were to withdraw $550 on 10/1 but have not. He believes it is $500. Again, he says not to worry. But I am worrying and trying to decide if I should contact EMC to verify that they received the On Demand letter and to make them aware that the returns (08/09) are en route. I do not want to lose my grandmother's home. My great grandparents built it for her as a wedding gift in 1927. Also, I do not know if Tre Ratliff is a lawyer or an assistant. He asked that I verify my bank acct # and then asked for the card #. I haven't anyone I can borrow the money from.

Renters ruined property and skip out on us.I called EMC Oct. '09 and wanted to work something out. I was told I must miss three payments or they could not even speak to me. I thought that was strange.Then the loan mod junk started and I was put on that program before I knew what it was all about. Ten months later, I was denied and they forgot to tell me. My credit has gone from 800 which it has been for 40 years to who knows what. I was denied a Target card and I am furious. I want them held accountable.

Trying to get a live person on the automated phone system is difficult or impossible. They claim that I am behind on my payments for a long time. I have proof that they cashed my monthly checks and they say no payments have been received. It is obvious that their booking system is no good. I am frustrated trying to talk to a person who sits in front of a computer who knows nothing.

The mobile homes were paid off and EMC refuses to send the titles and lien satisfaction.

I have the same story. I was placed on a modification, with a temporary status about one year ago. EMC has done everything to put me off, avoid helping me, mislead me and misrepresented me. I have paid the payment, sent every paper request within the time limit, kept in contact. I have had a hardship and was told that I qualify for the modification. What is the problem? I have done everything. I am going to lose my house. They put it in foreclosure. My wife is very ill. Help me.

We were having financial difficulty and filed for a loan modification on 3/31/10. We were advised that we qualified for the Making Home Affordable government program and we were put on a three-month trial payment arrangement. We made each of the three required payments on time. I then contacted EMC on 6/22/10 for the status. I was told that I needed to resend the entire application again because so much time had passed since we last sent it. I resent the application. I then called on 7/12/10 for the status and was told that I needed to resend the entire application again because some of the rules of the program had been updated and they needed all the documents to have the current date. I resent the documents again. The following is a timeline of what has taken place since then.

On 6/22/10, Stephanie told me to re-fax all application documents to **. I was advised that the Chase system would show them within 2 hours. I was told to call back and asked that it be escalated to a supervisor. On 6/23/10, I asked that our case be escalated to a supervisor. I was told it would be sent to Gina and to call back in 7 days to see if a negotiator was assigned. On 6/30/10, I asked Erin for status and who the negotiator was. I was told it had not yet been assigned. I asked to speak with a supervisor. LVM for Darryl **. On 7/8/10, I asked Valerie or Malorie for status. I was told it was still in review. On 7/12/10, I asked for status. I was told to re-fax form 4506. On 7/19/10, I confirmed the documents had been received, but I was told they had not been assigned.

On 7/22/10, I received denial for Making Home Affordable program. On 7/23/10, I called to find out what other options were available. I was told that we were now being reviewed for an in-house modification. On 7/27/10, Sandra told me that our in-house modification had been approved on 7/20/10. I was advised that Latisha ** was our underwriter and that our mod package would be sent via FedEx soon. On 7/30/10, I advised that paperwork had not been received and I was concerned about when and what next mortgage payment would be. I was advised that our next payment was not due until 9/1/10. I restated that and confirmed that we did not need to make a payment for August. I was told that we did not need to. I was advised that a message would be sent via email to Latisha ** to contact me about the status of the paperwork.

On 8/6/10, I advised Andre that the modification paperwork had not been received and that Latisha ** had not returned my call. I was advised that a message would be sent to her supervisor, Brent **, to return my call. On 8/11/10, I advised Mike that the paperwork still had not received and that neither the underwriter nor her supervisor had returned my calls. I was told that another message would be sent to Latisha **. On 8/17/10, I advised Jeremy that the paperwork was still not received and that neither the underwriter nor her supervisor had returned my calls. I was told that another request would be sent to the underwriter. On 8/17/10, Jake told me that our docs were sent out to us on 7/20/10. I explained that we never received them and needed new ones to be sent. I was told that emails would be sent to supervisors Derek ** and Tina **.

On 8/19/10, I advised Tisha that the paperwork was still not received and that neither the underwriter nor her supervisor had returned my calls. I was told that another message would be sent. On 8/26/10, I advised Erin that paperwork was still not received and that neither the underwriter nor her supervisor had returned my calls. I was transferred to Relationship Manager Brenda and she told me that she would have another copy of the paperwork sent to us. I was also given the number for the Relationship Manager line 866-703-5286. On 9/10/10, I advised Shelly that paperwork was still not received and that neither the underwriter nor her supervisor had returned my calls. I was again advised that our in-house modification had been approved by Supervisor Brent ** on 7/19/10 and that she would have this escalated to a supervisor today, that they were very efficient and would get the paperwork right out to us.

On 9/21/10, I advised Denise that paperwork was still not received. She confirmed what was discussed in my call with Shelly on 9/10/10 from notes on her system. She advised that she would escalate it to her supervisor Verge and that we should get the paperwork this Friday or Saturday. On 9/27/10, I advised Denise that the paperwork was still not received. Denise stated that her supervisor did look at it and that our in-house modification was still in review and had not yet been approved. She told me to call back in 3 weeks.

We applied for a loan modification on our mortgage based on their recommendation. They advised us to stop making our payments for 3 months, which we did. They advised us to comply with the loan modification requirements, which we did several times. We were informed that, not only did our loan modification go through, but that they had extended our mortgage to 32 years, and doubled our payments! We only had 8 years left on our mortgage. We are in our late 40's, worked hard all our life to pay our mortgage off, and now we are facing foreclosure! How on earth can this be legal? Please, please help us. There are so many other EMC mortgage holders who are gong through the exact same thing. You can read story after story of people that EMC has done this to online. We now are in arrears to the tune of $23,000, and facing foreclosure.

Where to begin. In trying to get a Home Modification situation with EMC, I've been through hours and hours on the phone, covering several months. When I called, the phone was initially answered by an automatic system, which would take me round and round their options. When I finally got a live person on the line, usually after a 6-12 minute wait, several times I was not understood due to the person on the other end not understanding English very well, if at all. This person would them abruptly put me on hold, where I would wait another 10-15 minutes. If someone actually answered, they requested my information again, then told me they weren't the right person/department, and I was put on hold again.

Another wait of 10 plus minutes, sometimes answered, but most often their phone system would hang up on me. In my opinion, the employees of EMC, whether in customer service or in the modification area, have been trained to pass off all calls as many times as necessary until either the customer gets fed up, or the phone system disconnects the calls. This training has apparently paid off for them. The ineptitude, ignorance, and utter stupidity of these people is awe inspiring. When I was finally able to get someone to send me their 'packet' of paperwork to fill out, I dutifully did everything asked of me. I had one question and was able to contact a local branch of their office in Glendale, CO for clarification.

Again, I followed their instructions to the letter. I was also told by the woman at this office that if I sent a copy of my Income Tax return, I would not need to use the form 4406-T. I filled all the forms, copied my return and sent it to the office in Glendale. Today, Sept. 25 I received a letter saying I didn't send all the information needed. This letter was requesting things not asked for in the original packet, some of which is not really pertinent to this situation. They ask that all information be enclosed in a single package, or it will be considered incomplete and will delay the process. I must submit the required items by fax or mail to the Lewisville office within 10 days of the date of the letter.

Interesting note: The letter is dated Sept. 17 - postage meter is dated Sept. 20 - second postage meter stamp is dated Sept. 21, the envelope having had insufficient postage stamped the first time. I now find I have two days to submit the newly requested information - those two days are a weekend. No mail delivery, no one in the office to receive it if it was even possible.

I've decided I'm not going to continue this fiasco with these incompetent, uneducated, inexperienced people any longer. I'm going to find someone else to help me. I will be contacting the BBB both in Dallas and Denver. I will be contacting the FTC, SigTARP, and the Special Inspector General for the TARP Program in Washington, D.C. I will be informing all these agencies about the misrepresentation and abuse by the employees of this company. Do not be deceived, they will treat you as badly as they have treated my husband and myself. This kind of stress is hard for me, as I have Multiple Sclerosis and am disabled.

My husband is now retired after quintuple bypass surgery. Our two sons have moved back in with us after losing their jobs. We've always managed to make our house payments, and still so. Other expenses have had to be set aside once in a while, but we're trying. We've been in this house since Nov. 1973. It's pretty much all we have. I sincerely hope you've garnered enough unhappy people to begin investigating this company, and will actually do something about it. We all appear to be scattered about the country, so someone like you needs to pull it all together for us. Get us some results, please. If not for me, then for the other people I've been reading about who are sometimes in more difficult straits than we are. I find this situation is worse since Chase took them over. Not that Chase is a sterling example of financial responsibility, any more than EMC.

Like most of the other complaints listed here, I too applied for the Obama Administration "Homeowner Affordability and Stability Plan". I applied for the program and sent in "all" of the requested paperwork. I was told that to be eligible for the modification and stop the foreclosure, I would have to pay 150% of my regular monthly payment, $3,342 for six (6) months. I signed the agreement and made all of my payments (Western Union Only) on time as agreed, then nothing! So, I resumed making my original payments.

Soon thereafter, I received the infamous "Notice of Expiration" letter, informing me that I failed to send in all the documents. I got no calls, no status reports and guess what? They could not find my application. So, my house is scheduled to be auctioned to the highest bidder on Oct. 5th. Shame on you Mr. President for allowing these unscrupulous serpents to pray on the American People! These are the same folks who lied and cheated and manipulated the financial markets to kill the economy. They get million dollar bonuses. We lose our life savings and our homes. Hey EMC, I got a job in a new career, making a third of my old income. My wife went to work too, after being a stay at home mom for 16 years! We make enough money to make the payments. Didn't the 6 months at 150% prove that? All we needed was a new start.

I refinanced with EMC mortgage 11 years ago after my divorce. Very easy to do everything was fine up until 2 years ago when the economy went bad and my work hours got cut in half. I did everything I could to stay caught up but it wasn't enough. I called repeatedly for help, different person everytime; no supervisor was ever available to speak to. I finally got on their modification program. I had to send in the same paperwork repeatedly. Back statements, paystubs, tax forms, etc. soon followed by a threatening letter saying they're going to foreclose if I don't send them copies of the same paperwork that is already sent twice or more.

I called again and told everything was fine ignoring the letters. I then got the threat of foreclosure letter again because they didn't receive a payment that was due on the 1st. My payments weren't due until the20th. I called again was told not to worry, everything's ok it was a blitz mailing, everybody got one. I've been making my increased payments on time as required and now I'm getting a letter from their attorney stating that they intend to foreclose anyhow because I haven't made a payment since July, I have a receipt saying I did.

They sent me August's payment back stating that it wasn't enough to reinstate the loan. What? Now what's happened to September's payment? I also wonder why I never got any written modification agreement with information on the payments and when their due, what part of each payment goes where, how far behind I was, etc. I never got any stubs either. When I called about that, I was told that I wouldn't get any monthly statements or payment stubs because they were too busy to do that, so I was forced to send payments blindly with only my account number on it and hope that it was going to the right thing. I don't even have a way to send extra money in to get caught up since I don't really know where it's going anyhow. Something is really fishy about this company and the way it does business, I hope somebody figures it out because I'm thoroughly confused.

I applied with EMC Mortgage on January 1, 2010 for a home loan modification. They requested several documents which would allow them to assist us. My husband and I were told to send bank statements every month and pay stubs so to better help with out loan modification. We called January, February, March, April, May, June, July, August, and now September of 2010 to get updates on the status of our loans. We were told to wait for an "underwriter" to contact us regarding the modification.

We completed our trial payments and were told that the fourth month which would be April is considered a "cooling off" period and on the fifth month (May) the "underwriter" would contact us. As of September 20, 2010, we have received no such call. We spoke to EMC today and were told our loan was denied, yet have not received anything in writing from EMC about our loan. Then on August 27, 2010, we received a letter from EMC requesting documentation because our loan was "qualified for a modification" although since January we've been in the process.

On September 20, 2010 at 1:00 p.m., we spoke to a representative named Sam who said he received our documents, but stated we were denied for modification on August 27, 2010. I'm at my wits end but refuse to just walk away from my home like so many other people have. This company is unwilling to work with us or contact regarding the matter, but will contact us only for "debt purposes" and something has to be done to stop them. I know we are not the only family in America dealing with this same issue, but we are tax paying citizens and are walking on eggshells in our own home because we don't know what will appear in the mailbox tomorrow. This involves getting a modification with EMC Mortgage. I've been working with them for 12 months. I'm on fixed income which I have verified many times. They keep asking me to reapply over and over even though I have sent my bank statements. Financial info. Nothing changes in my income. I'm 78 yrs old and retired from the government since 1998. I'm on medication for depression. Panic attacks.

This is taking a toll on me. I feel like they have no intention of giving me a modification. They've had me on a temporary payment plan of 950.41 each and is now saying they will refuse to accept my payment now. I pray you will be able to help me.You will be able to reach me on my cell: **. My Name is Cindy *****. My husband and myself are seeking your help in a problem that we are having with our mortgage company. Starting in February of this year, our mortgage company, which we do not have an escrow with. They paid our 2009 taxes in February of 2010. I am not disputing that we were late on our taxes. Matter of fact, they sent out our 2009 taxes three days before we did and never notified us that they had done so. The only reason that we found out that they did this is because our check came back for the tax bureau stating that our taxes for 2009 were paid. So I called the tax bureau and they said they were paid for by EMC Mortgage. I called EMC and they said that they paid the taxes because we defaulted.

I spoke to a lady by the name of Esmeralda. She said that all I had to do was send the check to them and I would have no penalties and to also send a letter that we would pay our own taxes and there would be no further problems because I had explained to her that I was out of work for 2 plus months for a total hip replacement and we were trying to get back on our feet. I was now sending my check for my mortgage every month by certified mail. They have cashed every check and then in August of this year, we get a certified letter stating that they would be foreclosing on us that we haven't made a payment since May 2010 but they were still cashing our checks which I have proof of.

I called them on August 30, 2010 and spoke to an employee Matthew *****. He said if I pay them $1464.64 and make Septembers payment of $487.97 that I would be totally caught up; I even sent an extra 47.39 in the check to help with the principal. So I sent them a certified check by certified mail. They signed and received on August 31, 2010, and it posted to our account. I called their automated system and it said the payment was received and my next payment was due September 1, 2010 in the amount of 0 dollars and 0 cents.

On Saturday September 3rd, 2010, we received a certified letter from them that we now were again in default and that they were going to foreclose and that we owed another $694.01. I called the automated system again and it now said that we owed that amount and it was due on September 1st, 2010 when 3 days before it said that we owed nothing for September. I have saved all recording of the automatic system. I am asking for your help to help me save my home for one and to stop this mortgage company from ripping people off the way they have been. They have been charged in the past for unscrupulous and ripping off consumers.

We have contacted this mortgage company numerous times and each time they tell us something different and say they will get back to us and never do

I have been battling with EMC since 2007. They make a tremendous amount of errors and suffer no repercussions. I am again in a foreclosure battle with them and was just notified of a sale date as they did not forward financials to their legal representatives as they said they would do. They also had advised me that I did not have to return the financial packet to Orlans & Associates because they would forward the information. To no avail they did not.

I have returned two loan mod packs, submitted the same information at least three times and yet to be assigned to an underwriter. I was informed yesterday at 4:50pm by Ralph S. that foreclosure proceedings will not be stopped while my information is being reviewed for loan modification. It is also of no relevance to my situation that EMC did not forward over my information, send me a bill, accept a payment and give me the run around for three years; nor any consideration to the fact that any mention of said mortgaged was removed from my credit history deeming it impossible to refi when all the laws for people with ARM's to do so. The list goes on and on and on. How can they get away with this? I don't know.

I myself applied with EMC in November 2009 for loan modification. I was told not to make a February 2010 payment and a partial for March because I made a full payment in November 2009. I thought things were fine until September 4, when I picked up my mail and discovered a demand letter for $11,000 by post office box. I called and got several stories.

One young man told me it was because I didn't make the February payment that I was told not to make. Another told me they don't send denial letters to post office boxes. One person told me I was denied two times--once in May and once in August. One stated that it was because I had only sent in part of my application. I mailed my application in January and had a confirmation by FedEx that it arrived in Colorado.

Three months later, I got a letter saying that they had not received my package. I stated that FedEx has confirmed that it was delivered. I called the Colorado Center myself and threatened the owner that I was calling the Secret Service (that package had my SSN). I contacted the local police and I was told that my mailing had probably been handled by illegals. They located the package after three days. It was entered at EMC.

I was told that the process was going on and that I should not have any worries. In June, a man came by my house and taped a note to the concrete part of my stairwell outside. I called, complied and provided more information for them. I still had not received the first denial letter that should have arrived in May. Apparently, he could tape personal information to an outside step but couldn't leave the copy of the denial letter?

I had to make the higher payment of $1,108 yesterday but they let me use the $600 I had in a suspense fund. Of course, I got the lie that if I make a payment every month before the 32nd day, that they would not take my account into foreclosure. I informed the lady that helped yesterday, "You do me dirty, it will come back."

I have nothing in my name except this house. My car and checking are all in a corporation's name (my company). I have not repaired anything and this house needs everything--roof, siding, guttering, furnace, central air unit, carpet, and paint. I will wait this one to the end and claim bankruptcy. I will keep everything but this dump. I will not fix anything until you approve me. I have been waiting since last November 2009 and I do not trust them. Now, they are sending me out another package. I have put a change of address on my home address which I have not gotten mail at for 14 years.

This is my message to EMC: a bail bondsman is the wrong person to play a game with. You will lose more than me. I don't have to pay lawyers. All I have to do is cry to a law firm that someone is messing with me. I will file bankruptcy and I won't even have to pay the filing fee. I will make sure that they eat it so hard that they cry. I will come out smelling clean as a rose with good credit within 18 months. Due to them, no one has good credit now. And I have several landlords that they would be more than happy to rent to me at a reasonable rate. So, EMC, you need to pull your head out before it's too late. I will survive, I will move on and you won't be able to tackle me for any of it.

I don't even know where to begin. I have never done anything like this before, but i feel we have to fight for our home. We have been trying to modify our mortgage with EMC mortgage for about a year now as my husband had a motorcycle accident and was out of work for about 8 months. We continued to make our mortgage payments as we used all our savings, cashed in our 401k etc. He finally went back to work but as the economy went down so did his pay. He has been employed at his company for 16 years.

We asked for help from our mortgage company. Applied for the modification, did everything they asked. Resending paper work over and over as they would say they lost it or did not receive it. Finally got smart and FedEx it. Even had the nerve to say at one point they did not receive all the paper work then. So frustrated, waited a week, called back and guess what it appeared.

I was finally put on a trial period and paid a lower payment as they reviewed everything. Called this month to make my payment said they could not take my payment as I defaulted on the terms. I did not. Again did not apply payment to my account. So now foreclosing is about to start. We are able to make payments and they won't take them. How can that be? We work, pay all our bills. How can they get away with this? I have been online and am so sad to read story after story of this happening to people. I thought the whole point of the Obama Plan was to help people keep their home. Guess not. I'm not sure even what to do. EMC I know has had a law suit in 2007 for scamming they have done. I guess there up to the same thing. I know it might be too late for me but maybe if enough people speak up we might be heard.

In Feb. 08, my husband and I began our modification with EMC, our existing lender. We sent in the reams of documentation, and got the dead-end answers to our inquiries, as many have already described. In Oct. 09, I was told there was no need to keep calling-our modification was with the underwriters, as it had been for months, and we would be receiving our contract in the mail. We continued to make the lower payment, as agreed upon, and waited. We don't know what's "normal." We do as we are asked to get the ordeal finished.

Now it is August 2010 and we still don't have a modification. They are saying we didn't return the signed contracts. In all those months, they didn't say a word. Now, the case has "closed" without warning to me, and they are telling me I didn't carry my end of the bargain. I worked on this daily for a year and a half, only to ignore the package that they sent? They say they sent it by UPS to our physical address. (We have a PO box, to which all other communication from them has been delivered. ) They don't even have tracking to back this up. Now they won't return my calls. We have much worse credit than when this started, and can't re-finance because we are behind on our mortgage.

Then after approximately 18 months of being on the reduced payments, I finally did receive a letter from EMC stating that foreclosure was commencing. WHOA! Wait a minute! I NEVER received anything from them as to why this was happening.

When I was finally able, after repeated phone calls, to actually speak to someone at EMC, they said that it looked like my application for the new mortgage was denied because I didn't qualify. News to me! And in order to stop the foreclosure proceedings, we needed to come up with $9,000 in back payments, interest and penalties! This is when we looked around and found this website and a couple others like it. We also in turn contacted a lawyer in our area who believes that we have a case against EMC. We are looking for other EMC victims to join our class action lawsuit against their bait and switch practices.

I have been attempting to finalize a mortgage modification with EMC since February 2009. It is now August 2010. I tried to be pro-active. I could see my income dropping. If the real estate market had not crashed and the value of my home had not dropped, I would have been able to re-finance at market rates and would not have had any problems making my new payments. But unfortunately, due to being underwater with my mortgage to home ratio, I could not re- finance. I attempted a modification before I was no longer able to make payments. I was denied initially. Why? Because I could still make payments, which of course was not going to last much longer. I was even told by multiple EMC employees that before they would even look at my papers, I had to miss 2 or 3 payments. They actually advised me to stop making payments!

Well, it didn't take more than 6 weeks after being denied (the first time) that I began missing payments. My credit got destroyed and then they quickly offered a 3 month trial modification period. That was 11 months ago. I have sent volumes of documents that have been lost or have not been reviewed in a timely manner and then have had to be re-submitted. They denied me in April 2010 because they decided that I was self employed, but I am not. And nothing in my documents states that I am and they have now 2 years worth of my employers' W-2s!

Several employees made notes in their system to get the underwriter's attention and try to stop their denial because to everyone, except this underwriter, it was clear that I was not self employed. But she never replied to me or even anyone at EMC. I was told to re-apply and keep making the trial payments, so I did the very next day. Within 3 days, I was able to verify that they received all of my information and that the underwriter was notified and a decision was due 30-45 days from the date that the file noted as complete. I verified this on 3 separate occasions, with 3 different people. I think for the first time I got the same information.

I was hopeful they had gotten their act together. Today, in a letter dated August 10th, I received another denial letter saying they didn't receive my documents in a timely manner and listed the options for short sale, foreclosure, etc. I feel like just totally ignoring them and using the money that I have been paying on the trial modification however I want. There are so many vacant houses in the area and I have heard that a lot of people have stopped paying their mortgages and nothing has happened to them. Why should any of us keep paying?! They operate in 100% bad faith. They have no intention of getting this dealt with, so why should we waste our time, energy, and money on them?! They have already destroyed my previously excellent credit. My guess is that I could live in my home for free. I don't use credit cards anyway and have no other debt.

I lost my job 1 /2 years ago. We hung on as long as we could till unemployment ran out. We notified EMC in November 2009 of our situation. They said a loan modification every month. They lost paperwork. No one would return our calls or e-mails. When you call no one knows anything. They transfer you all over and always get disconnected. Do they call you back? Of course not. After 6 months someone from EMC finally said, "Don't pay next month." Then they will do it its just sitting there. No one is working on it. We couldn't afford full payment anymore, only half of our mortgage payment, which is $1441.00 inc ins and taxes. Then we got 4 months behind because they still hadn't done anything, but they kept tacking on fees after fees. Then collections said if you don't catch it up, they won't even help you and they will deny it.

So we borrowed. My husband took every minute of overtime he could get and we finally got up. Guess what we got? A denial letter anyway saying we don't qualify. We called and they say we don't want you to lose your house and transfer you all over again and disconnect you. Where do we turn in the keys? No one will tell us anything. They even put in credit bureau during this process and ruined my 800 credit score. Now credit cards are dropping us. We are ruined because of these monsters. The president says he put these loans in motion, but no one can get them. Why isn't his people checking on these banks and seeing what's going on under there noses? We have been in our home since 1998; every penny is in this house. We are sick. My husband and I are now strained due to these monsters. Our marriage is seriously now strained. We cry all the time. No sleep. Physically, I've thought about suicide. Our lives have been on hold for 10 months waiting on these **.

You work all your life. We good people pay bills on time. You raise your kids and economy falls. Unless you're rich, you are screwed. We will now have to get rid of most everything, find a cheap apartment, and start over. No credit, nothing. Thanks, EMC: you ruined our lives. What goes around comes around. God is watching you.

My husband and I have been under a hardship modification plan for several years. EMC does not understand again that because my husband is 100% disabled veteran that we pay no taxes. Again, this month they tacked on their payment of our taxes to our mortgage payment. I have called every number I have for EMC and only get automation. Please someone help.

I have 8 duplex loans that were bought by EMC and I never missed a payment. They now show I am late on five loans and current on three loans. I cannot get anyone to call me back. I just got five refund checks of $76.80 each from them for over payments. They have reported it to the credit bureaus and hit my credit score of over 100 points.

My husband lost his job in 2009. We started to get behind on our mortgage and EMC offered us the Modification program in Oct of 2009. I sent all the information via FedEx. We sent our revised pay plan every month on time. This process was supposed to take 3 months. But received phone calls every month asking why we didn't send full payment and could we pay the back owed monies. (of course we could not) Then June 23, 2010, we received a letter stating that trial period plan offer has expired because we did not provide them with the documents requested and they had sent us a letter requesting the info. (I did not receive this letter requesting info). I would not have let that letter go for fear of the letter that I did get. This letter stated that they may be able to offer us other alternatives to avoid foreclosure. (forbearance, repayment, refinancing, Short Sale and Deed in Lieu of Foreclosure.) I don't want to lose my home, so I called.

I spoke to Nelson on 6/28/10. He said you need to call the underwriter Perla at 949-812-3294. I left a message on same day. No return call. So 6/29, I spoke to Billy. He told me he spoke to his supervisor and they will have Perla's supervisor contact me within 24-48 hours. No call back. On 7/12/10, I spoke to Ebony, who told me that my Modification is closed and that Perla would never call me, because they don't ever speak to the customers, they are too busy. She told me I need to fill out the online forms for Modification and Hardship and fax them to start all over again.

So I printed forms and filled out again and copied all my financials again. 7/19/10, I spoke to Ursula and she told me....Oh you are not starting all over again. We just need updated info. Fax the hardship/mod form from the internet, 2 months bank statements, paystubs, tax return, 4506T, Proof of occupancy. So I did that once all compiled. Also I should continue to pay the reduced payment of $680.51, unless I can afford to pay the complete payment.

I called today 7/22/10 and made sure all faxes were received. Diana told me that she did not know how long process would take but that Perla was the person in charge of modification on my account. Now, I guess I continue to wait for probably the next letter telling me that they don't have information and I am behind another $9,000. This can not be legal. A process that should only take 3 months has lasted almost 12. And I really can't afford my mortgage.

I have for a year and a half followed all the instructions, called to make sure everything was received and complete, been passed from one person to another (usually three different people each call), made all the payments asked. Everything was completed on time and I just received a letter saying that our application has been denied as they did not receive the required paperwork requested or on time. Yet when I followed this with a phone call I spoke to three different people who could not find any missing paperwork or that anything was out of order and that they had a record of my follow up phone call to double check that they had everything.

I asked to speak to the lady in charge of my account and she was not available (as usual). I left her and her supervisor a message and neither of them returned the calls. I believed these actions are fraudulent and must stop. We are honest people and never missed a payment until we were told we needed to do so for the application. These people have no interest in working with you and should not give the advice that they will. I have filed a complaint with the FTC and BBB and now here. We have lived on tenders for almost two years trying to make things work.

I have spent at minimum over an hour on the phone each time I have called and made all the payments for naught. I do not believe that these people are trying to work with you but to get as much money from you until they sense that they will not be able to much longer then they send out a form letter saying they have not received all the paperwork.

We started the loan modification process with EMC 6/2008 with two denials but EMC telling us to try again and again. Then October 2008, we hired a lawyer and finally EMC started to review papers that we submitted but would then follow a pattern, a misplace or lost paperwork, being shuffled to a third party company and EMC filing bankruptcy and would soon be purchased by JP Morgan Chase. We again had to complete many papers that again would be lost.

We personally hit an all time low in September of 2009 and could not make any house payment for the next three months. As we went to make the next house payment, the payment would be rejected with no reason provided to us or to our bank, Wells Fargo. We made many calls to EMC to find out why and there was no answer and no one could help us. Then I finally we got someone to help us on January 25, 2010 who found the error in coding by EMC. Once the hard coding was corrected the payment finally was accepted.

February 16, 2010, EMC sent us a letter stating they are willing to work with us and again we sent new bank statements, paystubs, tax forms and hard ship letters. We then sat and waited. Then on April 22, 2010, EMC faxed us new paperwork they wanted to be completed and we fedex'ed it back to EMC which they received on May 3, 2010. We sat and waited and made many phone calls. On June 15, 2010, we were assigned to an underwriter Sandrine *** in Southern California. We again made 10 calls with no response from her (***). Between these 10 calls, EMC was again contacted to ask what the issue was and if the underwriter assigned to us was correct. All was confirmed as a yes. Still no replies from the underwriter from the Loss and Mitigation department of EMC.

EMC again was contacted on July 8, 2010 at 2:06 PM and we found out that Sandrine ** was no longer assigned and that we would need new paperwork as we are coming up to the 90 day mark. It has been two years with being tossed around by EMC and still no loan modification has been completed. The only advice we have been offered by EMC was from Bill *** who on January 11, 2010 told us verbally to short sale our home as this was the best option. I do not see how this company can get away with this carelessness and lack of compassion.

How can I get help? Where can I go? I have done all I can do. Insurance companies have a deadline of 30 days to process and allow/deny a claim. These mortgage companies should be held to a standard deadline too. I do not see how it is okay to drag people along for two years. I have documentation of names, times, and detailed information should you need it. We had to resort in filing for bankruptcy on 12/2009 as after two years EMC still never completed the loan modification process.

I have been with EMC Mortgage for several years. My husband was permanently laid off in March 2009. I quickly applied for the new Make Home Affordable modification. EMC put me on a trial period after I sent in all the required information. They mailed me enough payment stubs for 6 months at a lower trial payment. When my stubs ran out in November, I called. I was told to keep making the lower trial payments because EMC was just running behind on getting to my modification. I continued to make the lower payments on time. I received a phone call in January telling me EMC did not have all the information they had requested. I immediately gathered and sent this information(much of which was duplicates of what I had already provided).

I actually faxed it and then mailed a copy to them. I heard nothing more until April 2010. EMC called to tell me they were missing a letter that stated my husband's unemployment benefits. The lady warned that I had to send this information right away because my modification application would be expiring soon. I again faxed and mailed a copy of all the information I could get our local Unemployment Security Commission to give me. I also included a note stating that any questions could be answered by (name) my husbands unemployment representative and included the phone number where she could be reached. I explained that my husband is under the "Dislocated Worker's Program" and will continue to receive benefits until he finishes college in the spring of 2011.

In the meantime, I emailed the main unemployment office and requested someone help me acquire an official letter stating my husband's benefits. I never got a reply or an official letter. Our local unemployment office said they do not write those official letters and I followed their directions in emailing the main office. I called several times in the month of April to check on the modification. I was told by EMC representatives that my modification was still being processed and to continue to make the lower trial payments.

On June 23 I received a letter from EMC dated June 15 stating I was not eligible for the Make Home Affordable modification. The letter stated I would need to pay the delinquent amount (which is well over $5,000.00) or I might be eligible for other options. I called to see if I could get an in-house modification or a repayment plan. The representative I spoke to said I was not eligible for any of those options-that my income was not enough. She said our financial info showed a negative. I hung up the phone and CRIED! If I could afford $5000.00 I would not have asked for help to begin with.

My monthly payment was about $580.00 a month, the lower payment was $384.00 a month. I have been in my house for 9 years. I don't want to lose it for $5,000.00. I called back the next day and a new representative informed me my in-house modification had not even been assigned to an agent yet. I told her my financial information had changed a lot-the info they were using was about a year old. We have a little more income now and have paid off a car. The representative told me she would mailed new modification/financial statement papers to me. I told her I had been told they would mail papers in the past and I had not received them. She promised me she would send the new papers that day. That phone call was June24. Today is June 29 and NO PAPERS!

I tried to get the new papers online, only to find the only modification papers are for the Make Home Affordable Program. There are not in-house forms on the website that I can find. I have even considered bankruptcy. My house is in my maiden name simply because I bought it before getting married. Will bankruptcy help keep my house or will it effect my husband also? I am sooooo lost. If anyone out there has any solution(s)

PLEASE HELP! EMC has made me promises and gotten me in a big mess. They assured me for a year that everything was going fine. Now I may lose my home for $5,000.00. There has got to be some legal issues with this situation. Can they cause my delinquent amount to rise while assuring me there is a solution and then expecting me to hand over a large lump sum because they were dragging their feet for a year? PLEASE HELP!

My husband and I were attending a community college so we could hopefully find jobs. Now I may have to quit to find some low-paying job to pay back some delinquency. We are now trying to save every penny to pay on the house. I go to a local food bank because we no longer buy groceries. I hang up laundry to avoid using the clothes dryer. We have cut every expense, even some necessities. My whole world has been turned upside down because of EMC Mortgage. Most days I cry. My duress is affecting my physical state. I have fibromyalgia and stress triggers it. I ache constantly now. I had some good days before but not now. Everyday is a struggle.

We went through a modification for 2009 finished up feb 2010 I call them and the lady said that it was a go she had received all the papers that they needed and didn't hear from them till I got my Annual Escrow Account disclosure statement it said what my total monthly payment would be 614.27 new payment effective date 05/19/10 so i sent them the payment and for june I sent them a payment and the I get this letter that they were unable to offer our home modification because they didn't send them all the documents that they needed but we sent them all that they sent to us all filled out and the lady said that it was a go that they had every thing now they are making us go through another modification and it it not right the way they do ther consumers

I cannot believe all the complaints I have just read about EMC Mortgage. Some of them could have been written by me because I have had the same experiences with them. I also applied for a loan modification with a three month trial period. It is now ten months and my application has been closed because my paper work is not current. I have been told I can reapply and resubmit all of the paperwork again. Why? They just keep asking for it over and over again. The can never find your paperwork when you call them, you speak to a different person everytime you call and get a different answer everytime you call. EMC gives you nothing but the run around, but tells you to keep sending in your payment or they cant process your loan modification. In the past ten months I have paid them over $22,000 and dont even know if I will ever be able to keep my house. I am at a loss right now as to what I should do. Do I submit the paperwork again and keep paying? Do I hold the payments in a separate acct and see what happens. How can EMC be able to get away with destroying peoples credit and taking away their homes in the end anyway?

Because we are/were unable to refinance out of our loan due to the market and loss of value on our home, we contacted EMC for an in house modification in 2008. They gave us the run around for a year and in Mar/Apr. of 2009 we heard about the Making Home Affordable plan and requested that.We were put on a 3 month trial payment plan which was the total of 31% of my income and told to send in the "packet". We ended up filling out and sending the paperwork multiple times(because they didn't receive it and told me to send it to Chase).

I finally sent the 40 pages of documents via UPS with a signature confirmation so they couldn't say they didn't get it and sure enough-they couldn't find it and said that even though they were merging, EMC and Chase were not able to access each other's computer systems(then why would you tell me to send it there?). After a few months of calling every day, they finally found my paperwork. Unfortunately, it took them so long to find it that they needed all new information again. At this point my 3 month trial payment has been renewed 3 additional times and I have made a year's worth of lower payments. What I have come to find out is that they have been reporting those payments as partial payments to my credit report and have been showing my payments as 120 days past due for a year.

When I finally received the modification agreement, it was for much higher than was previously discussed and the same rate we were at before we started the whole process. The only change was that they have ruined my credit by the way they were reporting it and they have put us $6000.00 in the hole by making us pay the "lower amount" for so long. Our ONLY choice now is foreclosure. If we stay in this mortgage, my credit will never get any better. They have not only reported my payments as late, but now they are reporting my balance as being higher than what I originally borrowed. We have paid over $100,000 to our mortgage company and we owe more than we borrowed. They have backed us into a corner. It is unfortunate that they are able to get away with doing this to consumers. I am looking into what sort of action I can take at this point. I have the majority of my correspondence either recorded electronically or on paper and I can prove my entire side of the story. Hope they can too.

After I modified my mortgage in 2007, I started pating to the modification department. I did not know that the EMC accounting department was not communicating with the loan modification department and reported me as delinquent for 4 months to the credit bureau. The credit card companies then lowered my max credit and made it appear that I maxed out on my credit cards. My FICO score further went down, and it all started with EMC messing up.

In 2009, I tried to apply for loan modification with EMC. I submitted a negative balance financial statement. EMC called me 2 weeks after saying that I was denied of loan modification and I had to pay $3K a month plus $1K. When I asked her why they denied me, she said I had extra money in my account every month. When I asked her what the + $1K for? She told me the same story.I told her (black woman) that I had a negative balance on my statement and I dont have extra money in my account since I owe IRS 12K. She wont forward my calls to the loan modification department and tried to deal with the situation herself when obviously whe was clueless. I slammed the phone on her and never got any calls from EMC ever since, nor did I receive any statments from them. EMC = bunch of morons!

I applied for a loan modification after becoming disabled. The company gave me a temporary payment amount that was supposedly for three months. It took a year to hear if I had been approved for the modification and the new payment amount is only $14 less than it was. They sent for the same paperwork four times, even though I had sent the paperwork when I made the application and they insisted the delay was because I had not sent the needed documentation.

I spoke to them in February in regards to a home mod. At which time they gave a huge payment for three months. At the third payment I question them and was told that I would just need to continue making payment until they were ready. Its now month four and I cant even speak to anyone they dont answer there phone.

This is not what I have in writing from them and I cant continue with these huge payments.

The payment page only allows for option to pay additional principal.I had plan to pay the late fees. Yet, every time, I did, they were not accounting for these late fees. They may be waived they may not. When you ask the representative about it, they just state that they cannot really help me.

I have sent 6 requests via fax and numerous phone calls to get a pay off since November 2009. They have applied my principal payments incorrectly. They sent a letter saying I needed to increase my flood insurance, $30,000. Well, I guess I didn't do this quick enough for them and they force placed the coverage for $340.00. Hello, that is more than the $150,000 coverage I had. I sent them proof that I increased the flood ($32 with State Farm), and they will not acknowledge or reimburse any of the escrow funds. Has anyone had any luck complaining to the BBB Pot Treasury department Federal Trade Commission? Who will listen? They are a company without integrity and seem their business practices are less than desirable to anyone. How do they get their business? I hope people start doing some research. I would have rather paid more interest to a company with integrity than go through this again.

Since December 2009, I have called and written requesting EMC to remove the escrow immediately. Every month since December, I have called and EMC continues to send me letters stating it needs to consider the matter further.

I recently requested EMC to delete a late charge reported to the credit bureaus and I was told that an investigation would be done. I was confident that once the record was reviewed, it would certainly be resolved in my favor. I now understand how the "customer care" unit could actually care less about the unique circumstances that a customer may find himself in through no fault of his own. Let me explain my circumstances yet again (assuming you will give me the time to read this letter). Please do take time to read this and consider changing your mind, because I will not rest until I receive a favorable outcome. I have never had a late payment on my credit report until now.

You did not do any investigating. It is so painfully obvious that it is an insult. I did not need to be offended on top of having my credit ruined. And yes, it is ruined to the point that I may walk away from this loan. It is upside-down anyway and it is an interest-only payment that will balloon soon. I hate to say it, but you may be doing me a favor.

I set up automatic payments at some point early last year and numerous payments were deducted from my Bank of America account. I had no reason to monitor the account closely. Isn't that the point of having such an arrangement on my end? I did not know that there was a problem until I received a letter in the mail stating I was two months in arrears. The day I opened the letter was the first indication that something had gone wrong. I called that same day and brought the account up to date. No one could give me an answer as to why the automatic payments stopped. Bank of America said it had nothing to do with the problem and I had no reason to doubt Bank of America because they are a class act. EMC was clueless. I asked for an investigation into the matter and was told someone would look into it. As you may imagine, I was never contacted with an explanation. I was upset that EMCs error put me in that position, but I did not pursue it because I was not charged late fees (that I know of) and I couldn't imagine that my credit would be comprised in any way.

Your "investigation" simply consisted of checking to see when the payment was due and when it was received. These facts were never in dispute and you should have known this. I was told that you would actually look at the record and consider my reasoning. Sometimes life happens because things go wrong with computers and the people who administer accounts. Isn't it nice when you've been a good customer for years (having paid many thousands of dollars in interest and always on time), just to have the relationship soured over a mistake by your company and, heretofore, without explanation. Put yourself in my shoes. EMC inexplicitly breached our legal agreement without notifying me and I am just dismissed as just another complaining defaulter.

I ask you to spend more than five minutes researching my complaint and refrain from summarily dismissing my rational clarification. If you decide not to do what is right for your customer, then please provide me with a name, address and phone number for the next-level contact. I am the victim here [times two] and will go forward with the fervor of one wronged. This is not just about me trying to fix my credit, it's also about setting the record straight and just maybe extracting an apology for putting me in this state of affairs.

We have been working for about two years to get a home loan modification with EMC. They just sent me a trial payment due for the making home affordable modification program. I would love to do this, the problem is they say it's per our discussion. Now for not making these new payments they say it will impact my eligibility for the program. I have never heard of this program before and they won't send me any information about it. You never get the same person twice. I write down every time I speak to them. I am so sick and tired of getting the runaround and nothing being done. I wish someone could help.

For the past 2 years I have been in financial stress. It came to me requesting a loan mod. to save my home. EMC put me on 4 repayment plans that were more than my actual house payments. They would not allow me to apply for a modification until after my mortgage was caught up. Then then told me my new mortgage with a modification would be $11.00 lower than my actual mortgage that I was paying.

I then had a company contact me that would buy my home in a short sale. This process went on for 6 months only to have the company back out because EMC would not communicate with them. I then put the house on a short sale with a realtor I have had 3 offers and EMC refused to accept any of them. I have as of today willfully returned my home to EMC. I am stressed and tired of the whole thing!

After calling to find out why my mortgage payment was not taken from my account (I called the payment in as I always do), I was told we had been denied the modification program we had been on since August 2008. The reason they gave me was that we had too much money left over each month. We had not supplied them with any new financial information. I was told we had $2700 left over at the end of each month and that we had 6 dependents. None of this is true. I have 3 grown children in their own homes and my husband does not have any children, nor do we have any excess income.

I tried to supply them with our current information and they refused to accept it. I am now getting letters of intent to foreclose asking me to contact them immediately to see if we can qualify for any programs. I have tried calling them several times and no one will talk to me or take any of my information. They are also claiming that they are paying my insurance when, in fact, I am paying my insurance myself. I cannot get anyone to listen or talk to me. I do not have the money to hire an attorney to help me save my home of 11 years. I would not have even known anything was wrong except I made that initial call to find out why they didn't take my mortgage payment out of my account.

Mr. *** hired Certified Financial Protection Group to procure a loan modification with his lender EMC. A modification was sent to EMC in April 2009 and again in June 2009 and the last time in January 2010. We have been unable to obtain a loan modification to this date. This has been a very stressful time not knowing whether the ***'s can remain in their home or not.

We are the authorized third party and have limited Power of Attorney for the above mentioned client. We have applied for a loan modification on behalf of the borrower. Their Home Retention Department had dragged its feet in obtaining a trial modification or a permanent modification for the borrower. My client has been in review since submitting in August 2009. We have called their institution several times and no one is willing to assist to escalate this file to see it finalized. They were denied twice for MHA and Business As Usual. I know there is a program that will help them. This client has sent in documents so many times and we are still no closer to a resolution than we were 6 months ago. This is completely unacceptable!

At this time we will be filing complaints with the Office of the Controller of Currency, the Attorney General in their area, Office of Thrift Supervision/Department of the Treasury, the Governor in the area, The Office of The President of their institution, and the Senator that governs their district in order to achieve some rapid results and obtain an affordable payment, which will keep this homeowner in their home.

It is sad that it has to come to this; however the President of the United States has specifically put programs in place to assist distressed homeowners to stay in their homes due to extreme family financial hardships, up to and including providing tarp funds to the financial institutions and its investors as an incentive to modify loans to eliminate foreclosure. On many occasions, we called their institution for an update on the modification, and on many of those occasions, we were given conflicting information. Additionally, their institution continually requests pay stubs and bank statements as well as other documents which we have to fax to you repeatedly. I am resubmitting my client's information again. I have about (20) additional files with their institution and I am facing similar problems with those files.

Every month I go through the same thing. I try to get them their payment and every month they tell me they never received my payment. If I send the payment through a wire transfer, it gets sent back because the account numbers and routing number they have me are changed. Then I tried to send a check by mail and now it's they never received it, although I have the return receipt and tracking sheet which shows who signed for the check.

I also have the cancelled check and they're still telling me they haven't received my payment. They threaten to foreclose on me all the time, but when I try to get them their payment, either they can't find it or it gets sent back. I'm at my wits' end. I don't know what else to do.

i have been trying for a loan modification, they tell me i havent sent in documeents which i have and i have proof of then they tell me i havent signed them when my copy that i faxed is signed so i have to keep sending the same documents again and again, they give me a number i must call and i am on hold for 45 minutes before i hang up , i fax and keep the receipt as well as priority mail with tracking,, i keep track of who i talk to and when and they still lie, when i took out the loan i had 2 incomes, now i have one, i have health problems and i take care of my 24 year old disabled son with cancer, i am not behind, but i am struggling, i am paying 10 and a half%, please help me, i have filed a complaint with ftc but they say they cant do much, i cant afford an attorney, he would or she have to work for a portion of the settlement

Husband and girlfriend fraudulenly used my social secuity number and name to buy a house with his girfriend. It is on my trw and emc will not speak with me about this matter. Can you help me clear this up?

I didn't recieve a November mortgage atatement and therefore did not pay it and contacted the mortgage company requesting a duplicate statement. it never came. I was then contacted by the mortgage company and I told them that I had not recieved a statement at which time they again promised to send me a statement. Still no statement. I received several more harrassing phone calls from the mortgage company for non payment on every occassion they promised to send me a duplicate statement eventually in repsonse to yet another demanding phone call I paid the verbal payment amount still with no statement and have despite all the promises to this date still not recieved a mortgage statement.

I have perfect credit and have never once missed a mortgage payment EMC has now reported my non payment to the credit bureaus, I think that the mortgage company is delibrately not sending statements to otherwise good paying clients in order to collect inappropriate late fees. Does the mortgage company have a legal responsibility to furnish the mortgagee with a statement and or coupon for payment. This is an option arm mortgage so the payment amount is nopt fixed.

I am a homeowner trying to save her home with a loan modification with the mortgage bank EMC Mortgage Corporation. I have been trying to get this application processed for almost a year now since January 2009. I have repeatedly sent in the documents requested and they have repeatedly misplaced them. I was so frustrated that I abandoned this first modification application hoping that things will get better. Unfortunately things didn't get better and I was still in need of a loan modification. I started the application again in May 2009 and it is now November and this company still is asking for the same documents that I have Fedexed and overnighted to them on numerous occasions. The representatives are calling me at least twice a day with the same requests. I am under the impression that they are deliberately trying to force me into foreclosure.

I am on a repayment plan and it ends in December. I was told on numerous occasions that they had all of the documents then a month later I would receive a notice asking for the same documents. One time it cost me $400 in CPA fees to get a Loss & Profit report that they have requested. I have done everything I was supposed to do and this company is not helping. My house value and income have dropped and I am in desperate need of this loan modification. The representatives at EMC are very rude and refuse to let you speak to a supervisor or management. I do not know where else to turn at this point. I can't afford an attorney unless I don't pay the mortgage.

I moved my account from wachovia to a credit union. Emc was drafting payments from my acc & I did not notify them I changed banks. I made my payment on time from new acc but Emc still charged me $25.00 for nsf fee's I dont see how that could be legal as long as they received payment on time.

I was very interested in purchasing a home we had found and all we had to do was find homeowners insurance. We got a wonderful quote through EMC insurance and purchased the insurance through them, paying a year in full. We purchased the house 1/13/2009 and on 3/2/2009 recieved a notice from EMC advising our policy was being canceled on 4/20/2009 for the following reasons: roof needs replaces, home is deteriorating, maintence and upkeep are not acceptable, and by the new policy they do not insure mobile homes. When we purchased the home it was not considered a mobile home, it is on a permanant foundation and maybe considered if anything a manufactured home.

The inspection that was done on the home prior to our purchase advised the roof was in fine condition and shingles have been replaced. The home is not deteriorating, it has paint peeling at one small section of one base, but the structure is in great condition and the inspection passed the home, it was also sold to us through the WY first time home buyers program, which goes through the government and inspects that is in good condition as well as having to pass several of their requiremnents.

When we purchased the insurance we took a picture of the home as well as the information from the real estate listing which showed the home and listed its details including manufactured home. At that time they still chose to insure the home. Now the only insurance quotes I have found are for triple what I was paying throgh EMC. EMC at no time sent us a letter of their findings in their inspections and at no time gave us an opportunity to do any repairs, if needed. We have requested the agent who came and did the inspection come back out to show us exactly where the home is deteriorating and where the upkeep is unacceptable, as well as explain how they considered it a mobile home, when it is on a permanent cement foundation, we have no scheduled date for that at this time.

On December 12, 2008 I contacted EMC Mortgage to make payments arrangements. I have two accounts with EMC Mortgage. Upon speaking with Bruno, we agreed that a payment would be made on 12-15-2008. On January 9, 2009, EMC Mortgage reported that I was 30 & 60 days late. That is very untrue and damaging to my credit

profile and it has impacted my credit sscores and causing me to have to pay higher interested rates among other things. I have enclosed conversations that I had with EMC Mortage starting on 12-15-2008. Please see below:

Crystal Shores 1306 Spoke to Felipe, Per letter I received rate adjusted to 4.8% (max down change allowed by loan contract). or 2174.15 He sates I now owe $5,827.. NO NO It WAS $3,165. that is outstanding per Felipe. I will need to pay this amount when i start making normal payments again.
Per Lisa in Loss Mitigation the account was assigned to SHERRY (phiatiam SP? ) in the TX office for the Loan Modification. States they need HOA insurance declarations page and Jennifers paycheck stubs AGAIN! Lisa is getting a negotiator on the line to assist??? Not sure why???

Tom is in the CA. going to have SHERRY call me back as LISA transferred me to TOM but he had no idea what's going on.. All loan mod payments brought up to current.

I applied with EMC Mortgage Corporation for a Modification Loan in January 2008. I was told by phone from the Loan Modification Representative (Teenesha) that my application was approved. She told me that it will take a while before the finalization of the contract. She told me that I would not receive anymore mortgage statements until I sign the contract. I received the contract on April 21, 2008 (it was dated April 17, 2008). I was told to sign the contract and send it back with the balance due by May 1, 2008. I called Teenesha on May 2nd to confirm delivery and she said yes, we received the contract and the money. She said your next mortgage is due on June 1, 2008.


My complaint is the mishandling of the mortgage funds. Teenesha told me not to send in any mortgage payments until the finalization of the contract. I told her that I have the money on time every month so could I just send it in. She said yes but your money will be put in a suspense account. I did that and this is what transpired:

1. I didnt receive any mortgage statements until July 2008 but instead I received late charge notices, default on my loan letters, and collection calls which started February 2008 until this present time.

2. On April 10, 2008 EMC had 2 late charges put on my credit report (for the months of March and April).

3. I received a call from Teenesha on April 7, 2008, she told me not to send in any more money because the Loan Modification Contract is now being prepared and I will be notified of the balance due. Three days after that the Collection Department messed up my credit report.

4. I signed the contract, sent the money in by May 2008, sent the June 2008 Mortgage in even though I still didnt receive a statement, and I am still receiving late charge notices, default on my loan letters, and collection calls.

5. I wrote many letters and even two letters to Gail A, Senior VP. No one seems to care or know what the other department is doing. There are four departments involved; Loan Modification, Customer Service, Suspense Accounts, and the Collection Department. If they would take the time to get together and exchange notes, correspondence, and phone calls (logs and recorded calls) this could easily be resolved.

6. EMC needs an interoffice communication system to avoid this unnecessary mishap that I am experiencing. I want those late charges taken off of my Credit Report, the bookkeeping updated, and an apology.

In 1994 we purchased our home. Stewart Title Co did the title search, 2 yrs
later we applied for a home equity
to upgrade our home. When we applied
we were told by our credit union that our deed was "No Good", the C.U. made
us produce a new deed that was correct.

We contacted our mtg co right away in
full cooperation to fix our deed with them. They ignored us, told us it did
not matter if the deed we held with them was no good, we urged them to contact the Title Company to fix our deed. They refused, we remined them we paid nearly $500 for title insurance which is for the lender, we expected them to work with the Title Co who produced the bad title search, correct our deed so that we had the proper paperwork. We kept insisting, they kept
arguing that they did not care. We tried to refinance but were unable to refinance the bad deed. It held a property description of 20 acres, our neighbors property. We owned 5 acres.
The Mtg co keep adding fees to our mortgage. We began with a $45,000 loand and had a $180,000 loan within

10 years. Just Greed!!!!!

While we were unable to sell our property with the bad deed, we held a good deed the credit union made us acquire. So finally after our mtg was sold several times and we had paid many legal fees to correct a problem we did not create

we told the mtg company you have what you have, you do not hold a deed to our property. They foreclosed on their deed for 20 acres. Then issued paperwork thru the sheriffs office to evict us from their 20 acres, the sheriff did serve us at our home with paperwork to leave the 20 acres.

We went to the sheriffs office with proof that we did not live on the property they were evicting us from . There
is a local realtor who is very agressive, he worked with the sheriffs office and locked our home while holding paperwork for a 20 acre parcel.
We had to leave. Believeing that this mtg company would not get away with fraudulent paperwork. Well they did.

The realtor sold the property, cash only, that way no title work was completed, passed fraudulent paperwork, deed, thru the county records office and literally without any legal authorization changed everything.

We have hired experts to research the

problem and conclusively proved that the deed was wrong, the mtg co refused to have it corrected, the title company did a bad title search and is not accountable at all. What a crooked system.

Emc Mortgage Corporation called me to let me know that I had not paid. I paid, but they did not know how to distribute the funds. It is not the only time they have done that. I wish the loan could be sold to another lender. Their services are the worst in this land. I am working so hard to keep the only thing I have. I am very sick of the way they treat me. I have been treated worse than a pet.

EMC mortgage Corp. made my credit look bad. I am really very frustrated from them for the last 5 months. Luckily I made my first close look into my loan activity. I found many mistakes, and it never stops. I have to make at least 2 calls to those people to fix their problem. I am mentally going crazy because of them. Something must be done soon. Please.
