RICHARD of WINDSOR, CA March 17, 2010 MR W. hired Certified Financial Protection Group to precure a loan modification with his lender EMC. A modification was sent to EMC in April 2009 and again in June 2009 and the last time January 2010. We have been unable to obtain a loan modification to this date. This has been a very stressful time not knowing whether the W.'s can remain in their home or not. Elmer of Hayward, CA February 9, 2010 We are the authorized third party and have limited Power of Attorney for the above mentioned client. We have applied for a loan modification on behalf of the borrower. Your Home Retention Department had dragged its feet in obtaining a trial modification or a permanent modification for the borrower. My client has been in review since submitting in August 2009. We have called [their] institution several times and no one is willing to assist to escalate this file to see it finalized. They were denied twice for MHA and Business As Usual. I know there is a program that will help them. This client has sent in documents so many times and we are still no closer to a resolution than we were 6 months ago. This is completely unacceptable! At this time we will be filing complaints with the Office of the Controller of Currency, the Attorney General in [their] area, Office of Thrift Supervision / Department of the Treasury, the Governor in area, The Office of The President of your institution and the Senator that governs [their] district in order to achieve some rapid results and obtain an affordable payment which will keep this homeowner in their home. It is sad that it has to come to this; however the President of the United States has specifically put programs in place to assist distressed homeowners stay in their homes due to extreme family financial hardships, up to and including providing tarp funds to the financials institutions and its investors as an incentive to modify loans to eliminate foreclosure. On many occasions we call [their] institution for an update on the modification and on many of those occasions we are given conflicting information. Additionally, [their] institution continually requests pay stubs and bank statements as well as other documents which we have to fax to you repeatedly. I am resubmitting my client's information again. I have about (20) additional files with [their] institution and am facing similar problems with those files. Steven of Marrero, LA January 19, 2010 Every month I go through the same thing. I try to get them their payment and every month they tell me they never received my payment. If I send the payment through a wire transfer it gets sent back because the account numbers and routing number they have me are changed. Then I tried to send a check by mail and now it's they never received it although I have the return receipt and tracking sheet which shows who signed for the check. I also have the cancelled check and there still telling me they haven't received my payment. They threaten to foreclosure on me all the time, but when I try to get them there payment either they can't find it or it gets sent back. I'm at my wits end. I don't know what else to do. rosemary of tobyhanna, PA December 30, 2009 i have been trying for a loan modification, they tell me i havent sent in documeents which i have and i have proof of then they tell me i havent signed them when my copy that i faxed is signed so i have to keep sending the same documents again and again, they give me a number i must call and i am on hold for 45 minutes before i hang up , i fax and keep the receipt as well as priority mail with tracking,, i keep track of who i talk to and when and they still lie, when i took out the loan i had 2 incomes, now i have one, i have health problems and i take care of my 24 year old disabled son with cancer, i am not behind, but i am struggling, i am paying 10 and a half%, please help me, i have filed a complaint with ftc but they say they cant do much, i cant afford an attorney, he would or she have to work for a portion of the settlement sherrie of rocklin, CA December 15, 2009 Husband and girlfriend fraudulenly used my social secuity number and name to buy a house with his girfriend. It is on my trw and emc will not speak with me about this matter. Can you help me clear this up? Giles of Kissimmee, FL December 13, 2009 I didn't recieve a November mortgage atatement and therefore did not pay it and contacted the mortgage company requesting a duplicate statement. it never came. I was then contacted by the mortgage company and I told them that I had not recieved a statement at which time they again promised to send me a statement. Still no statement. I received several more harrassing phone calls from the mortgage company for non payment on every occassion they promised to send me a duplicate statement eventually in repsonse to yet another demanding phone call I paid the verbal payment amount still with no statement and have despite all the promises to this date still not recieved a mortgage statement. I have perfect credit and have never once missed a mortgage payment EMC has now reported my non payment to the credit bureaus, I think that the mortgage company is delibrately not sending statements to otherwise good paying clients in order to collect inappropriate late fees. Does the mortgage company have a legal responsibility to furnish the mortgagee with a statement and or coupon for payment. This is an option arm mortgage so the payment amount is nopt fixed. Angela of Brooklyn, NY November 19, 2009 I am a homeowner trying to save her home with a loan modification with the mortgage bank EMC Mortgage Corporation. I have been trying to get this application processed for almost a year now since January 2009. I have repeatedly sent in the documents requested and they have repeatedly misplaced them. I was so frustrated that I abandoned this first modification application hoping that things will get better. Unfortunately things didn't get better and I was still in need of a loan modification. I started the application again in May 2009 and it is now November and this company still is asking for the same documents that I have Fedexed and overnighted to them on numerous occasions. The representatives are calling me at least twice a day with the same requests. I am under the impression that they are deliberately trying to force me into foreclosure. I am on a repayment plan and it ends in December. I was told on numerous occasions that they had all of the documents then a month later I would receive a notice asking for the same documents. One time it cost me 400 in CPA fees to get a Loss & Profit report that they have requested. I have done everything I was supposed to do and this company is not helping. My house value and income have dropped and I am in desperate need of this loan modification. The representatives at EMC are very rude and refuse to let you speak to a supervisor or management. I do not know where else to turn at this point. I can't afford an attorney unless I don't pay the mortgage. Norman of apopka, FL October 20, 2009 I moved my account from wachovia to a credit union. Emc was drafting payments from my acc & I did not notify them I changed banks. I made my payment on time from new acc but Emc still charged me 25.00 for nsf fee's I dont see how that could be legal as long as they received payment on time. Genella of Atlanta, GA January 2, 2009 I applied with EMC Mortgage Corporation for a Modification Loan in January 2008. I was told by phone from the Loan Modification Representative (Teenesha) that my application was approved. She told me that it will take a while before the finalization of the contract. She told me that I would not receive anymore mortgage statements until I sign the contract. I received the contract on April 21, 2008 (it was dated April 17, 2008). I was told to sign the contract and send it back with the balance due by May 1, 2008. I called Teenesha on May 2nd to confirm delivery and she said yes, we received the contract and the money. She said your next mortgage is due on June 1, 2008. My complaint is the mishandling of the mortgage funds. Teenesha told me not to send in any mortgage payments until the finalization of the contract. I told her that I have the money on time every month so could I just send it in. She said yes but your money will be put in a suspense account. I did that and this is what transpired: 1. I didn’t receive any mortgage statements until July 2008 but instead I received late charge notices, default on my loan letters, and collection calls which started February 2008 until this present time. 2. On April 10, 2008 EMC had 2 late charges put on my credit report (for the months of March and April). 3. I received a call from Teenesha on April 7, 2008, she told me not to send in any more money because the Loan Modification Contract is now being prepared and I will be notified of the balance due. Three days after that the Collection Department messed up my credit report. 4. I signed the contract, sent the money in by May 2008, sent the June 2008 Mortgage in even though I still didn’t receive a statement, and I am still receiving late charge notices, default on my loan letters, and collection calls. 5. I wrote many letters and even two letters to Gail A, Senior VP. No one seems to care or know what the other department is doing. There are four departments involved; Loan Modification, Customer Service, Suspense Accounts, and the Collection Department. If they would take the time to get together and exchange notes, correspondence, and phone calls (logs and recorded calls) this could easily be resolved. 6. EMC needs an interoffice communication system to avoid this unnecessary mishap that I am experiencing. I want those late charges taken off of my Credit Report, the bookkeeping updated, and an apology. Report Your Experience
