Beneficial

James of Smithville, TN October 17, 2008

James of Smithville TN (10/17/08)
We had a house fire on 9/7/08 and our insurance company cut a check to us and Beneficial. We overnighted this on 9/24/08 and were told of the process of payment to the contractor or 30%-30%-30%-10% and the first 30% would be cut in the next few days. We went through faxing and refaxing documents to them over the next week and a half. Everyday since they have said they will overnight the first 30% (granted the inspector has already been for the and seen completion for the next 30%). They still will not do anything and we are at a loss on what to do.

At this point they have stopped construction on the house and we are out of the house. This is putting undue anguish on my family (wife and 2 daughters) at a time that is already very difficult. I don't know what to do.

I took a loan out to pay for a custody case with my daughter and my father cosigned. I hit a period where I was financially in a hardship they told me they put my parents house on a lien but I qualified for a hardship program. I made three really large payments to them and my payments were to be reduced from 380. per month to 180 . I am making my payments and they still call 20 times a day and they call my parents and my husband at work just as many times. They harass and things seem like one person says one thing then does another and then turns the account over to someone else and nobody knows anything about your account and the payments that you have set up

It is really depressing when you are trying to pay and get yourself out of a hole and the constant harassment and threats that they will put a lien on your parents home makes your body ache you want to cry all the time. Someone please stop them from doing business like they do.

I have spoken to many people within the HSBC business regarding my mortgage. We got a mortgage that allowed us to have an interest rate drop if we paid 12 consecutive payments on time and without any problems with our account. Well, it seems that we fulfilled the requirements and not because we did so, they are not being allowed to enter our payments that are still being made on time or ahead of the due date. The payments are being counted as late and we are being assessed fees because of it. We have contacted the company locally and at the telephone numbers that they have and the issue is still not corrected. This has been going on since July 2008.

We have received a foreclosure notice from the company even though we have made all of our payments ahead of time for the full term of the loan. I need the name and telephone number of the state and federal agencies that regulate the company so I may file a complaint and secure assistance. This bogus situation has caused considerable strain on our marriage and it looks as though we will end up in divorce court if this does not get cleared up soon.

We need help immediately, please send us the requested information as soon as possible. I need to file suit agains't HSBC/Beneficial to show my wife that we are moving in a correct direction to solve this situation and regain our peace. I have copies of all paperwork that show payments and phone and personal contact with the company. I do not want to have a physical showdown with this company or any other company because they wrongfully tried to take our home from us.

I have had a stroke and have heart trouble that is being made worst by this incident. Our marriage is being threatened by the lack of financial security that exists because of this situation.

We had a home mortgage loan with Beneficial in 2001. We refinanced with another company in 2003. In 2004 we were having money problems and received a check for 7100 from Beneficial-just sign the back and the money is yours. My question -Is the loan with 25.000% annual monthly rate and 2.084% monthly periodic rate fair? This loan started in 2004 at 7100.00 is now at 6879.54. The last 6 months we have been paying 150 never late and have a finance charge every month of 138.62.

It is becoming a terrible hardship trying to pay this with the cost of everything rising. In May 08 we got a reverse mortgage on our house which helped. I am 69, my wife 65. She has MS and requires an outside care giver daily. We live on 3000 monthly and with everything going up- this winter is going to be hard.
