My uncle called me and was very concerned because a woman called his home and left a message for me stating that I was a person of interest in a criminal case against me and that it was urgent that I return her call.
First of all, I do not reside with my uncle and I feel this company had no right to leave a message for me there. When I called the number back, a person by the name of "Lisa" answered and I told her I was returning a call and that I didn't appreciate them calling and leaving such a message on my uncle's answering machine. She asked for my name and put me on hold for a long time. When she returned, she said that I was being investigated and would be prosecuted if I didn't pay them $476 for a payday loan that I defaulted on years ago at Ace Cash express. She said that she saw that I had no prior warrants or arrests and that it was a courtesy call to let me know that I had until 10 a.m. the following morning to pay them the full amount or else they would process an affidavit and I would be arrested.
She said that I would be facing two felony counts. She used the terms "malicious intent to defraud a money institution" and for "writing worthless checks". I argued with her that I did no such thing and she said that there was surveillance video and a thumb print on a check. I argued that it was a payday loan that I couldn't pay back at the time and was going to take care of it as soon as I could but I never intended to defraud anybody. She became very rude and insulting and told me that it didn't matter. It wasn't being looked at as a payday loan at this time, and I had to pay the money or else. She accused me again of fraud and said that I shouldn't have been going around writing worthless checks.
I said I would like to contact a lawyer and she became very angry. She told me that I better go get a MoneyGram of the full amount and call with the confirmation number or else. Then a man came on and started screaming at me. He said that he wasn't going to sit and listen to some thief argue with his agent and threatened that he was going to take the paperwork upstairs to be processed and that I would be arrested. He asked me in a very threatening manner if I was going to pay it or not and I said I was going to talk to my lawyer and he laughed at me and said, "Yeah right, like you are really going to get a hold of a lawyer at 6 p.m." I responded that my lawyer is a friend. And he said rudely, "Oh right, you have a friend for a lawyer. Why don't you tell him that you wrote worthless checks?" I told him that he had no right and he screamed, "Well, I hope he's a criminal defense lawyer because you're going to need it **," and hung up the phone.
I called back very angry and the lady answered again and I asked for that man's name. She told me his name was Jim ** and he was the manager. I told her that he can't be going around talking to people like that and that I would call the BBB. He got back on the phone and yelled, "Well maybe I should call your family and tell them that you are a criminal," and that he would find out where I worked and threatened to inform my boss and coworkers that I was being prosecuted for felony fraud so I would lose my job and that if I had any children, that he would report me to child services. He said, "** you, I'm processing the paperwork to have your ** arrested. Good luck," and he hung up on me again.
My grandmother, sister, and mother all heard the entire conversation and were utterly shocked how that man spoke to me.
