Class Action Filed

Janet of Ewa Beach HI (1/14/04):
I have been using the Sam's Club credit card for a couple of years. It was a convient way to shop, charge at Sam's Club and then pay the balance when it was due every month. Until I began receiving late charges on payments I knew should have been received on time. After paying them once or twice I began to get suspicious.

Then in July of last year I received a call from the "bank" saying I was behind in my payments. I knew this wasn't true since I pay the total due every month. I called the telephone number given to me and checked and yes it said I had a zero balance. The following day I received a bill stating I was overdue on my payments. I have my cancelled checks for the amounts charged and I have the cancelled checks to prove they were paid and cashed by MCCBG. None the less I am still getting "bills" from the "bank" for bogus purchases. I was sent a bill in December for a purchase they claim I made in June. I did not charge that has not been paid for in full.

I stopped using the card in July after all of these problems. On top of everything else they are trying to get me to pay a bogus charge and then they added a "late" fee. I have written to the company twice, called numerous times and they are still sending me invoices that are bogus.

I refuse to pay the amount because it is not owed to them. I paid everything in full. I am filing a complaint with the Hawaii Office of Consumer Protection. I have been advised to pay the bill so my credit rating won't be damaged. this is not right, the company has been sued many times and should be put out of business.

If Janet is worried about her credit rating, she should pay the bill, then sue the bank in Small Claims Court to recover the amount wrongfully charged.

L.F. of Giddings, TX sent the following to Monogram on Dec. 19, 2000:
I am in receipt of your rather laconic letter of December 5, 2000. I have no intentions of paying the $45.76 charges that you have accepted on a credit card that I never owned. It is true that I applied for a Sam's Credit Card over a year ago and was informed that the card would be limited to $100 total purchases. My reply was that I very seldom, if ever, spent under $100 on any visit to Sam's and that I would continue to use my Discover Card.

At that time I stated that I did not want the card and I never heard any more from you. I was never issued a Sam's Credit Card. Let me reiterate, I do not recognize or acccept your $45.76 charges, much less the finance charges. I wish you luck in finding who issued this card and who charged on it. Please, don't bother me again with your problem.

Bill of Port Charlotte, FL, writes (12/8/00):
Discrimination Against Class of Citizens! I have had the same problems the others have had with Monogram Band ie: Double Billing, Late Fees, Rude Treatment. HOWEVER in Florida, Monogram has an additional con going. They know a large percentage of Sam's Club Credit Card holders (at least in the Port Charlotte Area) are disabled and receive Social Security on the 3rd of the month. Well guess what? The 3rd of the month is the date a late fee becomes due AND THEY WILL NOT CHANGE YOUR BILLING DATE!

This violates the Americans With Disabilities Act since a whole "Class" of citizens are charges late fees merely because they are disabled. I was cussed by Monogram when I tried to change my bill date. That denied me "Meaningful" access to their bank since I am disabled and under doctor's orders to avoid all stress. It won't be long and I'll be filing a Pro Se Civil Action.

When Bill says "Pro Se" he means he'll be filing the suit himself, without benefit of counsel. We're not sure this is a good strategy.

Ralph of Federal Way, WA, writes (12/19/00):
I was sent a denial for credit card. I never applied for a card with the Sams Club. The notice was sent to my address with my correct name but wrong social security number. This will cause a negative showing on my credit report in which I work hard to maintain.
